A q&a about v.o.: talking tearooms, movies, Morrissey, and melancholy with filmmaker William E. Jones

Parts of Peter Berlin’s and Fred Halsted’s bodies of work are now a part of William E. Jones’s body of work, thanks to the recent 59-minute video quasi-mashup v.o.

But the bodies in gay porn pioneers Berlin’s and Fred Halsted’s movies aren’t what interests Jones. More than bodies, he scouts cities — through the eyes of those directors and others (and the voices of countless other filmed and taped sources) v.o. cruises spaces now gone or under surveillance, often doing so with a prophetic sense of doom. It’s one of many Jones works which reveal that the most fascinating aspects of movies, and of life, often dwell on the outer edges.
Born in Ohio and now residing in L.A., Jones currently has two handsome websites, one devoted to his films, and the other, Shiftless Body, focusing on his photographs. In conjunction with an upcoming screening and a feature in this week’s paper, I recently interviewed him via email:

PREVIEW The public furor set off last November by the imminent publication of onetime football star and Avis flunky O.J. Simpson’s now-quashed book, If I Did It, on the murders of his ex-wife, Nicole Simpson, and Ron Goldman, demonstrates how pivotal the 1995 Simpson trial was to so many, just as Newsweek‘s recent publication of details from a key chapter shows how much it continues to compel — and how tender the wounds remain on this country’s notions of race, justice, media, and celebrity. To many TV viewers overseas, the trial might have merely summed up the insanity of stateside news priorities when the World Cup telecast was interrupted for the Simpson Bronco chase, but for Kota Ezawa, who had just transferred from the Kunstakademie Düsseldorf to the San Francisco Art Institute (SFAI) at the time of the trial, it was ripe, rich stuff.

The televised Simpson verdict announcement — documented in the snippet Ezawa reworked for his brilliant 2002 short animation The Simpson Verdict, now showing at the Museum of Modern Art in New York City — "was really a shock to everybody, but a very different kind of shock," Ezawa said. "It was a real kind of shock and a very strange shock because it wasn’t a bomb hitting the ground! It was just a court official saying two words, ‘Not guilty,’ and it was enough to send really huge seismic waves through the entire nation. That I find interesting — that it was so psychological, a psychological event."

Sitting at a work table scattered with paper collage scraps of fallen soldiers intended for his 2006 "The History of Photography Remix" project in a spare, white one-room studio at the corner of 16th and Mission streets, the soft-spoken, even-tempered Cologne, Germany, native in a brown hoodie seems like the last person who’d gravitate toward incendiary subject matter such as the Simpson trial. Or the assassinations of Presidents Abraham Lincoln and John F. Kennedy, which are paired in his 2005 animated short The Unbearable Lightness of Being. From the aforementioned pieces to 2003’s Who’s Afraid of Black, White and Grey, Ezawa’s work boils history-making spectacle down to ultraflat pop shapes and hues — adding another layer of commentary to the race cards dealt in The Simpson Verdict. Though Ezawa’s works mimic the primitive, jerky moves of South Park, they rarely make light of history’s dark corners — rather they are minimalist meditations on memorable images, sampling, quoting, recropping, and editing visual pop ephemera and masterworks culled from our collective memory’s moving-image files.

And Ezawa’s reenvisionings, or remixes, have found a growing audience, eliciting an enthusiastic review in the New York Times for his current exhibition at Wadsworth Atheneum Museum of Art in Hartford, Conn. SF Cameraworks recently feted the new Nazraeli Press volume compiling Ezawa’s "The History of Photography Remix" works, and this week the San Francisco Museum of Modern Art includes the artist in its biannual Society for the Encouragement of Contemporary Art (SECA) Art Award Exhibition.

"We were all enormously impressed by his practice — its clarity and range, the distinctness of his vision," SFMOMA painting and sculpture curator Janet Bishop wrote in an e-mail. "He was a top contender from the start of the award process." As a SECA award recipient, Ezawa will show parts of "The History of Photography Remix" as well as a two-screen animation, Stereo Stolen Honeymoon, which he described as a trailer for a longer adaptation of the purloined Pamela Anderson and Tommy Lee wedding and honeymoon video, which the Guggenheim Museum is in talks to show.

"The Anderson-Lee tape is really most striking for how mundane it is," Bishop continued. "It has only become iconic because of our cultural response to it. Ezawa’s piece holds a mirror to our collective obsession with every tedious detail of celebrities’ lives."

A yearlong project featuring Ezawa’s idiosyncratic, hand-drawn computer animation and aided by assistant Ryan Thayer, voice actors, and assorted interns, the Anderson-Lee piece is also one of the artist’s most overtly comic pieces: the tabloid twosome’s cartoonish lifestyle slips seamlessly into Ezawa’s format as they exchange aggro vows, stroke tats, and chat up their pooch.

"I feel that I’m in the business of making moving paintings more than I’m in the business of making videos with a beginning and an end and a kind of dramatic curve," the 37-year-old self-described "video guy" confessed across his work table. "It’s a different kind of attention that people bring to a gallery or to a museum, and in that way, it almost has to work like a painting, meaning some people will watch it for 10 seconds, some people will watch it for a minute, but it really depends on how they will get grasped or not grasped by the image."

PRIMAL SCENE


The half-Japanese, half-German artist traces his own initial attempts at image-making to ancestors. "If you ask any artist, if they’re really honest, there will be something way, way, way back — even sometimes before you were born," he said with a small grin. The drawings of his great-grandfather Hans Gelderblom, an architect, made an impact, as did his Japanese forbears’ silk paintings and bronze vases.

As a child in rural southern Germany, Ezawa etched his own path with cartoon flip books and hand-cranked panorama boxes resembling TVs. "I think there’s one thing about the countryside that informed or really influenced me and why I am how I am now," he explained. "In the city I think even as a teenager there’s already these peer groups — sometimes it’s ethnic, the Latino kids or the Asian kids, some listen to punk music or some are really good at school or math. In the countryside it doesn’t really work like that — you’re just stuck with your age group, so one of your friends is a fantastic athlete and a piano genius, and your other friend is a borderline alcoholic heavy metal fan, and you all just converge and hang out. And so I think even today … I sometimes think I don’t have any taste, you know?"

That ability to switch from high to low, between mediums and messages, fed his work at the Düsseldorf art academy, where he tried his hand at photography and performance art before scoring an opportunity to study with Fluxus video art innovator Nam June Paik. "He wasn’t there a lot, but to me, he was a really big inspiration," recalled Ezawa, who made his first video in order to be in Paik’s class.

At first he put together "still videos that didn’t move at all": one of his first, I Want to Buy the Empire State Building, was made when the structure was actually for sale. Working pre-Photoshop, Ezawa used a graphic machine to print the title sentence along with his phone number, reproducing the words on a C-print before hanging it on the wall and videotaping it. Paik had the piece, along with other student works, shown at the Anthology Film Archives in New York City. "What’s similar to the videos I make today was I didn’t think of video as this entertainment format," Ezawa said. "I thought of video more as a light box. It was really just like this illuminated image coming out of the TV."

TAKING OFF ON HISTORY


Ezawa’s light-box reworking of Yves Klein’s Leap into the Void — part of "The History of Photography Remix" — looked down from an otherwise pristine wall above us. After finishing his BFA at the SFAI and his MFA at Stanford, Ezawa began teaching at California College of the Arts. While poring through the school’s slide library for a presentation on the history of photography for an introductory media arts course, he found himself thrilled: "I thought it was almost like DJing. ‘Oh yeah, this one will be really good. Maybe I’ll play this one after this one.’ " He took the Klein image home, scanned it into his computer, made a graphic sketch over the original, and kicked off his own "History," a compendium of transparencies, slides, collages, and intaglio etchings drawing on images as disparate as Ansel Adams landscapes and the surveillance shot of Patty Hearst and the Symbionese Liberation Army at the Hibernia Bank in San Francisco. "That kind of became the idea for the work, to make this fake history slide show," he said.

Ezawa’s strategy stirs up the familiar cauldron of copyright issues in this age of digital reproduction. "You could call it visual hip-hop," he quipped. "But you can also call it somehow ripping off." He’s had only a few "sensitive reactions" from the creators of the original images. "I had long discussions, and it all got resolved," Ezawa said. "But with the book it was like, ‘OK, if you’re making this book and you’re ripping off tens and tens of photographs, you don’t want to have 30 angry photographers sending nasty e-mails." So in an effort to avoid a Simpson-like "legal nightmare," he contacted every shooter he sampled, and "the reaction was 95 percent very positive."

The SF artist has understandably mixed, and remixed, feelings about copyright, which he describes as being "really used to protect the interests of Walt Disney [Company] as opposed to actual artists. But then I feel like events like YouTube really help everybody and also the emergence of China as an economic player in the world, where they have Dior handbags that might say ‘Djor.’ I do think copyright might not exist much longer, though maybe long enough to ruin all of our lives."

He gave a compact chuckle. But then, the artist who once sang and played keyboards along with his wife, Karla Milosevich, in the Helen Lundy Trio seems to have his own quirky handle on the problem. "You know, like any hip-hop artist or DJ, I find my ways to manage this." *

The Pentagon has released to the Guardian and the American Civil Liberties Union 534 pages of documents reutf8g to domestic surveillance — and we don’t know much of anything new about the notorious Threat and Local Observation Notice (TALON) program.

The vast majority of the documents, released under the Freedom of Information Act, are entirely blacked out or heavily redacted. It’s clear there has been a lot of high-level discussion about policies and procedures related to military spying on civilians — but the government isn’t coming clean about more than a sliver of it.

One thing the records do show is that the Pentagon at one point had between 12,000 and 13,000 files in its TALON database — and 2,821 contained information about "U.S. persons." At least 186 of the reports in the files involved antiwar or antimilitary protests.

The Guardian and the ACLU went to federal court in 2006 to demand access to Pentagon records related to domestic surveillance after Santa Cruz Students Against the War and the Berkeley Anti-War Coalition compiled evidence to suggest that they had been the subject of TALON spying.

TALON was originally designed to monitor threats against military bases, but its mission expanded to encompass, for example, protests against military recruiters on the Santa Cruz campus. Pentagon officials admitted in December 2005 that the Santa Cruz student group was spied on under the TALON program.

In fact, documents we received earlier show that data about the student group were shared with the Department of Homeland Security and the Joint Terrorism Task Force, which works with local police agencies (see "No End to Pentagon Spying," 7/5/06).

Initial documents received last year showed that, as of early 2006, there were no clear rules barring the military from conducting surveillance on peaceful protesters. The new documents indicate that in January and February of that year top Pentagon officials ordered a review of procedures and set some restrictions on retaining files on people who were not considered imminent threats.

One document states that information on protesters "has not been provided by recruited sources of information" — in other words, the military wasn’t sending spies to watch protests — but concludes that "this statement is not intended to state that TALON reporting could not result from recruited sources or tasked personnel."

That only confirms what we had learned already: that there is no formal ban on armed forces personnel spying on protesters or planting sources inside peaceful groups or peaceful protests.

However, the operation seems to be winding down a bit. By June 16, 2006, one of the few uncensored documents shows, TALON reports had dropped by 80 percent.

It wasn’t easy to get even these highly censored records. The Guardian-ACLU request was stymied at first, and only after Federal Judge William Alsup on May 25, 2006, ordered an expedited review did the US Army, Navy, and Air Force begin to grudgingly release a few tidbits of information.

It’s astounding how heavily redacted the documents are. Page after page after page shows that high-level policy discussions around TALON and domestic surveillance were taking place at the Department of Defense in January and February 2006 — but military officials won’t reveal a bit about the nature of those talks or the policies that resulted.

"The amount of information that’s redacted is significant," ACLU police practices lawyer Mark Schlosberg noted. "We understand the need for certain information to be kept confidential, but discussion about policies involving domestic surveillance is something the public has a strong interest in." *

The simple act of witnessing can transform sex into politics, so it’s not hard to see why privacy (like permission) is sacred. The quaint notion of the boudoir is ingrained in most acts of physical intimacy — whether lovers seek haven in the bedroom or take joy in rejecting it. More like Wild Kingdom than Girls Gone Wild, the CineKink 2007 series at Yerba Buena Center for the Arts neutrally observes sexual transgression: the forms it takes, the relief it offers, and the privacy it (often jubilantly) breaches.

More fun than watching actual webcam girls, Aerlyn Weissman’s doc WebCam Girls (Thurs/18, 9 p.m.) looks at three successful mavens and frames their stories with academic analysis. These women all began their journeys in the world of semivoyeurism from a place of corporate exploitation, so it’s ironic that they, like their patrons (commonly nine-to-five cubicle dwellers), are surveyed at work … well, at their home offices. In this surveillance their homes are as public as their patrons’ cubicles — to the 15 people (as opposed to 15 minutes) for whom they’re famous. Their identities are their brands, putting them in vulnerable positions both figuratively and literally.

Almost a brother film to WebCam Girls, Damon and Hunter: Doing It Together is a short feature nested in the Passion Plays Program (Fri/19, 9 p.m.). For the women of WebCam Girls, the issue of individualism is essential (Anna Voog makes Rorschach-inspired videos for her word-association songs, and Ducky Doolittle puts on fashion shows), but Damon and Hunter are like Rosencrantz and Guildenstern: porn stars with protected identities as opposed to global brands. Primarily composed of one talking head interview with the two lovers, director Tony Comstock’s documentary intercuts a XXX scene that is more sweet than erotic. The footage feels deliberately contrary to a porn aesthetic, giving the impression that we’re observing, with anthropological so-called neutrality, the well-worn sex life of a couple. One partner asks, "Are you comfortable?" and the request for consent is like a demonstration of love.

Unlike the docs in the CineKink Series, Going Under (Sat/20, 7 p.m.), a sensitive and occasionally vague narrative feature, expressively represents the erotic and ultimately calmative values of nonvanilla sex. Psychoanalyst-turned-filmmaker Eric Werthman’s movie is about a relationship between psychoanalyst Peter (Roger Rees) and his dominatrix, Suzanne (Geno Lechner). Exhausted by her field of work, Suzanne announces her retirement, which signals an opportunity for them to see each other "outside." The two bond over childhood trauma: for them, history is a tragic theme. "I can never forget how we met" is an important sentence: not so much shamed as burdened, Suzanne struggles with the couple’s desires outside the security of her leather-bound workplace.

Fans of Going Under will find a good companion piece in Howard Scott Warshaw’s documentary Vice and Consent: The Art of Wrapping Intimacy in Very Scary Paper (Fri/18, 7 p.m.). Offering a more incisive view of BDSM (bondage and discipline, dominance and submission, and sadomasochism) than Going Under, Vice and Consent initiates a remarkable dialogue about the transcendence that results from this highly rigorous discipline. The hour-long doc has a homespun production value that gives a kind of authenticity to its interviews but also somewhat clouds its dialogue about sex as an exploration of human consciousness. Exhaustively, this film discusses the means by which the community rejects "vanilla" — and poetically, the world outside vanilla is as infinite as the characters who go searching. (Sara Schieron)

Secrecy wins, 4-3

Late last night, after all the debate about surveillance cameras was over, the San Francisco Police Commission narrowly voted down a plan that would have made a strong statement against secrecy in police discipline.

The vote was 4-3,. with the usual pro-cop suspects, Louse Renne, Joe Marshall and Yvonne Lee joined by the swing vote, Joe Alioto Veronese. He should have voted the other way.

Here’s what happened: After the state Supreme Court came out with its atrocious ruling in a case called Copley, essentially enshrining all cop discipline cases in a veil of secrecy, Commissioner David Campos proposed an intriguing idea: A lot of disciplinary cases are settled before a formal trial. That’s usually to the benefit of the cop, who can accept a lower penalty in exchange for, in effect, pleading guilty. Campos suggested that the commission simply state, as a matter of policy, that no cases would be settled unless the officer involved agreed to waive his right to confidentiality and let the public know about the charges and the outcome.
That would simply continue the way things have been done for the pas 14 years, prior to this horrible court decision.
When the idea first came up, Alioto Veronese supported it, but over the past few weeks, he’s backed away. And last night, with a bit of a convoluted explanation, he cast the deciding vote to shoot down the Campos proposal. Not good.

By the way, the meeting ended with Campos and Commissioner Theresa Sparks demanding that Chief Heather Fong explain her rather bizarre statements on police foot patrols.The chief had initially argued that foot patrols would never work, because the department didn’t have enough staff. Then she presented her her own foot-patrol plan. Then she was quoted in a TV interview as appearing to say that if the supervisors passed the law, she’d ignore it anyway.

What, exactly, was the chief’s position, and how did it change so radically from one day to the next? Fong ducked beautifully. But the commissioners promised to bring the issue back.

No more surveillance cameras

OPINION In July last year, San Francisco began installing video surveillance cameras to monitor the public streets. What quietly started as a pilot program with two cameras in the Western Addition has quickly expanded, with more than 30 cameras throughout the city. The Mayor’s Office is seeking to install 22 more cameras at a number of locations, including heavily trafficked areas such as the 16th Street and Mission and 24th Street and Mission intersections.
On Nov. 15 the Police Commission will decide whether to approve the installation of additional cameras. It should reject the mayor’s proposal and send a strong message that scarce public safety dollars should be spent on less intrusive and more effective programs such as increased foot patrols, improved lighting, and community policing.
While surveillance cameras may seem like an intuitive solution to the serious problem of violent crime, in reality cameras pose significant threats to civil liberties while providing few public safety benefits. Study after study demonstrates that video surveillance does not reduce violent crime in cities.
In Britain, for example, where there is one camera for every 13 people and the average person is photographed more than 300 times a day, a recent comprehensive review of 13 jurisdictions showed that cameras do not reduce crime or fear of crime. A University of Cincinnati study found that cameras in its city merely shifted crime beyond the cameras’ view. As Cincinnati police captain Kimberly Frey mentioned in one recent news report, “We’ve never really gotten anything useful from them…. We’ve never had a successful prosecution…. We’re trying to use … money for other things.”
With limited public safety dollars, cameras deprive more effective programs of funds that would significantly reduce crime. Studies show that improved lighting can reduce crime 20 percent, and increased foot patrols have also been shown to significantly impact crime, including violent offenses.
Moreover, the ever-increasing expansion of surveillance cameras poses a significant threat to our privacy. The prospect of 24-hour surveillance of innocent San Franciscans — with video accessible to city officials and the public under state open-records laws — is chilling in and of itself. If the trend continues, cameras installed today may be paired with other new developments, such as facial recognition and Radio Frequency Identification technology, giving law enforcement the ability to develop dossiers about our personal lives.
While San Francisco has some regulations governing camera use, those regulations have already changed and may change again, due to an overreaching political response to crime concerns. To see San Francisco’s future, one need only look to the inspiration for the program — Chicago. There, Mayor Richard M. Daley recently announced a plan that by 2016 would put a camera on almost every street corner in the city.
In light of the significant privacy and free speech implications and limited public safety benefit, the Police Commission should decisively reject further camera placement and strongly urge the mayor and Board of Supervisors to pursue effective programs. San Franciscans deserve more than symbolic measures like video surveillance cameras in response to very real crime problems. Scarce public resources should not be spent on ineffective Big Brother surveillance programs. SFBG

One of the stronger arguments for vegetarianism is variety: there are far more kinds of vegetables and ways of preparing vegetables than there are meats and ways of preparing meat, even if you eat mutton. (And know where to get it.) Fish and seafood too are more various than meats — or at least they have been. There is growing evidence that most of the world’s major fisheries are drifting toward collapse; the British author Charles Clover gives a chillingly thorough review of the evidence in his new book, The End of the Line: How Overfishing Is Changing the World and What We Eat (New Press, $26.95).
Eating fish, then, is no longer presumptively virtuous. It matters what fish we eat: farmed or wild, how and where taken if wild, health of the overall population, and so forth. Earlier this year, while reacquainting myself with Hayes Street Grill after some years’ absence, I noticed that the menu card now gives a good deal of information about the sources of the restaurant’s maritime dishes. The plain assumption is that diners want and need this information, that they are beginning to understand that choices about food involve a moral dimension and that considering the moral dimension of one’s choices need not ruin the meal nor the evening.
Given HSG’s position as an exemplar, I was curious as to whether its attention to sourcing might have begun to influence other seafood houses around town. One of the most obvious places to start looking would have to be Alamo Square Seafood Grill, which since the middle 1990s has sat atop a romantic stretch of Fillmore a block from the hilltop park that provides its name. From the beginning, Alamo Square borrowed a page from the HSG playbook by letting diners choose from among several varieties of fish, cooking method, and sauce. One difference: you did not get fries, as at HSG. On the other hand, there was — and remains — an early bird prix fixe option, three courses for $14.50 and a reminder that Alamo Square began as an offshoot of that long-running prix fixery, Baker Street Bistro, at the edge of the Presidio.
The restaurant looks none the worse for a decade of wear, except that the northern face of the street sign (wreathed in Christmassy little white lights) has lost its initial A: if, trekking uphill, you come across a place called lamo Square, you are there. Inside the storefront space, the mood is one of candlelit intimacy, and the crowd is varied, consisting largely of people in their 20s and early 30s (neighborhood folk?), along with the occasional interloper. A youngish couple who had Marina written all over them arrived in a silvery Aston Martin coupe, which they parked in the bus zone right outside the restaurant’s door. Oh Department of Parking and Traffic, where are you at those rare moments when you could actually be useful? Not that some DPT timeliness would have mattered in this case, since the canny pair took a window seat with a view of bus stop and car.
Our first order of business was establishing which of the proffered fish we might conscionably eat. Trout: no, a farmed carnivore, with aquafarming the cause of environmental pollution and carnivorous fish requiring on the order of four pounds of wild fish to return a pound of salable flesh. Mahimahi: attractively firm and abundant, though flown in from Hawaii. Red snapper: a local fish with decently managed populations, just a wee bit boring. And … an ahi tuna loin, prepared according to a set recipe. Tuna is dicey: bluefin is a no-no, other varieties somewhat less so.
Red snapper ($13.95), luckily, takes well to blackening even if it’s just the Pacific kind, not the true variety from the Gulf of Mexico. We found the mâitre d’hôtel sauce — basically a garlic and parsley butter — to be just assertive enough to make its voice heard without challenging the fish. The more party-hearty Provençale sauce — of tomatoes, black olives, capers, and garlic, a combination reminiscent of Neapolitan puttanesca — made a nice match with grilled mahimahi ($13.95), a fish that, like chicken, welcomes a little help and usually benefits from it. Platters of fish (not too little, not too much) were served with brown rice pilaf and a mélange of sautéed vegetables, among pattypan squash, zucchini, carrots, and button mushrooms; none of this quite matched good French fries for excitement, but it was all pretty tasty and much lower in fat.
The kitchen handles nonfish dishes with equal aplomb, from an amuse of wild-mushroom pottage spiked with a little balsamic vinegar and presented in demitasses to a fabulous salad of shredded romaine hearts ($6.75) tossed with crisp lardons, slivers of carrot and French radish, garlic croutons, blue cheese, and lemon oil. A soup ($6.25) of artichoke and fennel topped with pipings of curry oil was desperately underseasoned — all we could taste was the sweetness of the fennel — but a few good pinches from the tabletop salt dish coaxed the artichoke flavor forth.
There was even an occasional flash of wit, as in a tarte tatin ($5) made with pears instead of apples and presented in the au courant, deconstructed style: the pear slices were fanned over a floor of pastry. It looked a little like a pear pastry lasagna the chef hadn’t quite finished putting together. On the side, a pat of vanilla ice cream nodded to tradition.
As we left, we noted the Marina couple chattering away in their little surveillance box and the Aston Martin still sitting in the bus stop, ticketless. TECHSPLOITATION I think ubiquitous digital surveillance and searchability have given me a weird new sense of entitlement. I feel like I should be able to find anybody on the Web, and if I can’t — well, why not hire somebody to search the databases I can’t access? I caught myself having this exact bizarro train of thought the other day, when I was trying to locate an old friend of mine from high school.
I did all the usual things that generally yield results and have helped me find out all kinds of useless things about lost childhood friends. (That hardcore rocker boy is now a real estate agent! No way!) First I searched on his name in Google, but all I discovered was that somebody with his exact (and fairly common name) died in the Twin Towers. There was a catch though — my old friend went by his Korean name in high school but adopted an American name in college. So I started searching on his Korean name, feeling very clever. Unfortunately his Korean name is actually more common than his American one. Then I narrowed my searches, looking for his names in connection with our hometown, his college, and the city where he lived the last time I saw him. I searched news groups, MySpace, LiveJournal, and Technorati.
At last I couldn’t think of anywhere else to search. That’s when I had the aberrant thought: why not just hire a private detective? Everybody’s doing it — even HP! And I’d get one that wasn’t too expensive. Admittedly my subconscious was spiked with reruns of Veronica Mars and memories of This Film Is Not Yet Rated, a documentary in which a guy hires private detectives to figure out who the members of the Motion Picture Association of America ratings board are.
But I think I hit upon this rather extreme idea — hiring a detective to find my old friend — because I’ve become conditioned to think that all information should be accessible. Despite my belief in online privacy and anonymity, my unexamined, knee-jerk response to the situation was that somebody should be able to get this guy’s contact information for me. I mean, all I wanted was an e-mail. I wasn’t trying to get his home address or voting records.
Needless to say, I did not get a private detective, nor have I found my old friend yet. I’ve avoided becoming creepy but I’m left unsatisfied. The old promises of the Web, which David Weinberger famously characterized as “small pieces loosely joined,” have turned out to be quite different from what we all imagined. Many of us are connected, sometimes to a degree bordering on incestuousness, but many of us are not. The threads do not attach to each other. Names are lost in a sea of names. People fill blogs with entry after entry that never get read, never get linked, never receive comments. Certainly there are spirited local debates that bring us together online and amateur writing that’s as findable as a New York Times headline, but these things are rare and getting rarer. The Web is beginning to feel just like a city street: you can see all the houses, but you have no idea what’s in them. Unless you’re a thief.
I feel cheated by the walls that have gone up on the Web — not the walls that protect my personal information, but the ones that prevent me from finding friends (real friends — not friendsters). They aren’t the same walls, by the way. Walls that protect personal information should prevent people from getting access to whatever crap ChoicePoint and Visa have on you. The walls that stand between me and my old friend are the cacophony of filtered data that the Web has become. I’m sure his e-mail is out there somewhere floating around, but because he hasn’t been writing a popular blog or posting obsessively on the Linux kernel list, it’s got no juice on the search engines. Because he’s not socially findable, he’s not technically findable either. And no, it’s not because he has no e-mail. The guy is an engineer. So much for the Web breaking down barriers.
I’m going to try one last time to find him — but this time, I’ll go at it from the other direction. I’ll call his name and see if he hears me. Let’s see if there are any holes in those walls. If you know a guy who goes by Lawrence Kim or Chong Kim and who once lived in Orange County, let me know. Especially if you are him.

Hip buzz phrases

TECHSPLOITATION Usually I don’t let the PR e-mails get to me. My standard procedure is to review and delete these missives from alternate marketplace universes where people care about incremental changes to the graphic user interface in a piece of useless software. But last week when the bizarrely clueless announcement from domain-name megaregistrar Dotster arrived in my inbox, I just couldn’t stand aside and let it pass.
Maybe I was feeling particularly grumpy because the ongoing Hewlett-Packard scandal is constantly reminding me that all my nightmares about the corporate surveillance of media types are, in fact, true. Whatever the reason, I just got plain pissed off by Dotster’s craven bid to appeal to youth with its new PimpedEmail product for MySpace users. For $7.95 per month, Dotster will sell you access to a “pimped” domain name via your MySpace account. Apparently, according to the press release, these domains “tend to favor hip buzz phrases … for example, if a visitor types ‘Stephanie’ into the DDS search box and clicks ‘Name Search,’ the results might include stephanieisthebomb.com, stephanyshizzle.com, or worldofstephanie.com.”
OK, it’s true that what leaps out immediately here is the slap-your-head stupidity of these “hip buzz phrases” — my personal favorite is worldofstephanie, which has to be one of the buzzingest, hippest phrases I’ve ever encountered. But what pushed me over the line from merely bemused to actually offended is Dotster’s crass attempt to suck money out of one of the most cash-strapped communities on MySpace: unknown musicians trying to get people interested in their music.
Most of the suggestions for how to use PimpedEmail involve using it to promote unknown bands. “A new group calling itself Nikki Blast could use band search to register nikkiblastrocks.com,” suggests Dotster. Then “they can set up as many e-mail addresses as they like using that domain extension. For example, the drummer could be madbeatz@nikkiblastrocks.com, and the band could award loyal fans with their own addresses such as timmy@nikkiblastrocks.com.” Hmmm, could “madbeatz” be another one of those hip buzz phrases? What about “rocks”?
Of course these suggestions won’t necessarily control youth behavior, partly because they’re just lame. And I’ll admit that MySpace teaming up with Dotster isn’t nearly as problematic as MySpace collaborating with state governments to police what kids are doing on one of the world’s largest social networks. But PimpedEmail is more insidious than you might think. It pushes conformity under the guise of cool; it turns the ideal of freely sharing band information into something that requires payment by the month.
No, it’s not surprising that the News Corp.–owned MySpace is figuring out ways to accessorize its free service with little nuggets at teen prices. I still reserve the right to be grossed out when it happens.
More depressing still is the way PimpedEmail pulls the covers over the true process involved in doing one of the most basic tasks of any Web user: getting a domain name and setting up e-mail. The Dotster press release describes its service as a “unique Domain Discovery System (DDS),” adding helpfully that “visitors to the service’s Web site can generate unique domains.”
Huh? There’s nothing “unique” here — this is the usual way one searches for domains and buys them online. Every time I’ve ever bought a domain, apparently, I’ve had a “unique” experience when I searched to see if annaleenewitz.com (for example) was available and then purchased it. The only thing that’s different here is that instead of getting boring suggestions for domains (like annaleecompany.com), you’ll get allegedly cool ones (like annaleeshizzle.com).
The misrepresentations here go beyond the usual “we’re unique” marketing ploys. Dotster makes it seem that getting a domain and getting e-mail are the same thing — and that the easiest way to do both is through MySpace. Let’s leave aside the privacy issues involved in tying your MySpace page together with your e-mail and domain services. I’m more worried that services like PimpedEmail will actually lower technical literacy in Web users by hiding what’s really going on when you create the address madleetz@worldofannalee.com. Not only does PimpedEmail take money away from its users, it takes away their knowledge of how domain names work — and by extension, it takes away just a bit more of their power. SFBG

Trash hits Toronto: part two

FEST REPORT Because I’m psychotic, I jammed 22 movies into six and a half days at the Toronto International Film Festival — and was actually pissed at myself for not seeing more. Out of curiosity, I sprinkled in a few prestige pictures: Ken Loach’s The Wind That Shakes the Barley, about the early days of the Irish Republican Army; and Pedro Almodóvar’s Volver, starring a Penélope Cruz so va-va-voomy that it’s almost a relief when another character asks her if her chest was always that enormous.
I knew it’d be tough to top my two early favorites, both detailed in last week’s Guardian: from Korea, monster movie The Host; and from Hong Kong, Johnnie To’s stellar, Sergio Leone–infused gangster story Exiled. Several came mighty close though, including Andrea Arnold’s Red Road — about a woman whose numb existence spent watching surveillance camera footage is rocked when a man with ties to her tragic past happens to stroll into her line of vision. Not only is Red Road exquisitely directed, it features the best acting (particularly from lead Kate Dickie) of any film I saw at TIFF. That’s not a slight against the always-excellent Christian Bale, star of Werner Herzog’s Rescue Dawn, whose Fear Factor–influenced portrayal of a jungle-bound prisoner of war erases all memories of Batman (but not, perhaps, freaky foodie Patrick Bateman).
Fellow Bollywood fans know a Shah Rukh Khan performance is not to be missed under any circumstances, though committing to the 192-minute Never Say Goodbye meant missing out on a few other screenings in the process. (It was worth it.) The fangirl mentality also drew me to Darren Aronofsky’s The Fountain, a polarizing work I heard variously described as “Aronofsky’s 2001” and “Aronofsky does Soderbergh doing Solaris.” Yep, it’s a bit baffling — but in a weirdly spellbinding way. Hugh Jackman, you are almost forgiven for Van Helsing.
TIFF’s documentaries were an overall strong bunch. Prickly American History X director Tony Kaye takes on America’s pro-choice–pro-life debate in the nearly three-hour Lake of Fire. Though the film’s most graphic images are (barely) muted by Kaye’s decision to shoot in black and white, the content — especially the interviews with right-wing extremists — is just as shocking. Other top docs: Macky Alston’s The Killer Within, about a nice, normal family grappling with the knowledge that 50 years prior, its patriarch shot and killed a college classmate for the murkiest of reasons; AJ Schnack’s Kurt Cobain about a Son, which takes the experimental approach of layering audio interviews with the late musician under newly shot footage of Cobain’s Northwest stomping grounds; and the more conventional punk celebration American Hardcore.
The fest’s lightning-rod film was Death of a President, a made-for-British-TV faux doc that imagines what would happen if George W. Bush were assassinated. (Before you start cheering, feel the terror of these words: President Dick Cheney.) JFK remains my favorite dead-prez whodunnit, but Death of a President manages to maneuver its scandalous concept into a perceptive take on post-9/11 civil liberties.
One last thing: do I have to give back my film critic’s wings if I say Borat Cultural Learnings of America for Make Benefit Glorious Nation of Kazakhs was my favorite TIFF movie? Because if loving Borat is wrong, I don’t wanna be right. (Cheryl Eddy)
FEST REPORT Navigating TIFF’s public screenings often leads to a heavy bout of queue fatigue. You line up to purchase tickets, to pick up tickets, to get into the theater, and invariably to get into the exclusive confines of the ladies’ room. And then there’s the peculiar indignity of the absurdly named “rush” line: the film is already sold out, so if you want in, you have to take the chance that there’ll be a no-show ticket holder you can replace. And that requires waiting forever.
But being the first to discover little gems makes it all seem worth it: Agustín Díaz Yanes’s Alatriste (starring an español-speaking Viggo Mortensen) plays like Disney’s Pirates of the Caribbean if Uncle Walt had done a tour of duty in Gallipoli; the Canadian National Film Board doc Manufactured Landscapes follows photographer Edward Burtynsky on a fascinatingly meditative trip through the industrial wastelands of China; and Apichatpong Weerasethakul’s Syndromes and a Century, the perfect companion piece, offers a brilliant, surreal slow boil on urban alienation in an increasingly modernized Thailand.
Of course, there were disappointments too, like Catch a Fire, Phillip Noyce’s well-acted yet underwhelming biopic of South African freedom fighter Patrick Chamusso. And let’s not forget the schlock, like the silly slasher film from Montreal’s Maurice Devereaux. I squinted when the director credit came onscreen, pretending for a moment that I had made it to the TIFF big time but winced at the sight of the movie’s irony-soaked title: End of the Line. FEST REPORT I’m writing hours after the start of the Toronto International Film Festival’s 31st edition. Opening nights are a ritual for film festivals, and this one is no exception. The big show is always a Canadian feature: this year it’s Norman Cohn and Zacharias Kunuk’s The Journals of Knud Rasmussen, the follow-up to the same team’s hit from five years ago, Atanarjuat: The Fast Runner. I’ve seen the best and worst of Canadian cinema over the years at these opening nights, but I now choose to skip the red-carpet mob of Toronto’s moneyed finest in favor of an alternative: at the Elgin, one of Toronto’s best movie palaces, an international feature with high hopes unspools to an audience of cinephiles with equally grand expectations. To the collective joy of those assembled, The Lives of Others hits the giant screen with appropriate splendor. Already said to be Germany’s contender for the Oscars (a prospect that isn’t necessarily promising), this debut feature is much more than the usual polished Euro gem aiming at the global market. Director Florian Henckel von Donnersmarck studied political science and economics as well as filmmaking, and it shows. Here is a man who can think about his society and who, moreover, trusts the specificities of history (in this case, 1984 in the German Democratic Republic) to speak to the present. Like Good Night, and Good Luck, Henckel von Donnersmarck’s The Lives of Others begs us to pay attention to history. In Germany — the film suggests — the days of political thugs abusing power to control a population are over. “To think that people like you used to run a country!” its writer-protagonist explodes in a pivotal scene to an ex-politician in the lobby of a Berlin theater reviving the former’s old socialist realist play. Here in George W. Bush and Karl Rove’s America (where the wiretapping that dominates Henckel von Donnersmarck’s film is a reality), no such comforting escape into the present is remotely possible. But The Lives of Others could be a lesson to US filmmakers on how to create complex characters that lead an audience through complex issues — to think and feel at the same time, as the director’s compatriot Rainer Werner Fassbinder once put it. The Elgin Visa Screening Room (yes, that’s the name — festival sponsor Visa is inescapable) vibrated with passion at film’s end. Directors aren’t supposed to come back onstage at the opening-night screening, but the standing ovation demanded it. And the applause wasn’t only for Henckel von Donnersmarck’s very real achievement as the writer and director. Lead actor Ulrich Mühe — who gives an extraordinary performance as a conflicted Stasi agent — had been an East German theater actor under heavy Stasi surveillance. There he was, onstage too, a living storehouse of historical process. At a festival where politics are already emerging as a major focus, this jewel of a flashback may well be a flash-forward to the year ahead. (B. Ruby Rich) FEST REPORT I may be an American journalist scuttling around in Canada, but so far all of my top picks at the Toronto International Film Festival hail from Asia. South Korea’s The Host is a film you will be hearing a lot about in the near future — especially if you’re anywhere near my yapping mouth, which will be (loudly) singing the praises of Bong Joon-ho’s colossal monster jam for months to come. Kinda like The Texas Chainsaw Massacre, The Host is inspired by a true incident. According to a 2000 Korea Times article, an American civilian employee of US Forces Korea was jailed for ordering the dumping of toxins into Seoul’s Han River. That he happened to oversee a US Army mortuary was a particularly juicy detail. As The Host imagines it, the freaky chemical combo births an underwater mutant. We don’t have to wait long to get a full reveal either: it’s a huge, mouthy sea monster, complete with dexterous tentacles and the ability to gallop across land, perform graceful backflips, and swallow whatever unlucky human being gets the hell in its way. Naturally, the local population freaks — especially a sad-sack father (Song Kang-ho, who also played a sad-sack father in Park Chanwook’s Sympathy for Mr. Vengeance) who watches helplessly when his young daughter gets lassoed by the critter. The Host follows his oft-ridiculous plans to rescue her with the help of his brother (an educated drunk) and sister (a competitive archer who tends to choke when it counts). The film also chronicles the Korean government’s strong-arm approach to handling the “river incident” — with the help of the US Army, which would just as soon incite even more panic by claiming the monster is the source of a terrible and mysterious new virus. Bonus: The Host boasts killer special effects by San Francisco’s the Orphanage (Sin City, Superman Returns) and New Zealand’s Weta Workshop (The Lord of the Rings trilogy, King Kong). With cutting political and social commentary gurgling just below the surface and black humor spurting from every orifice, The Host (due for a Magnolia Pictures release in 2007) is a must-see for monster movie fans — and jeez, everybody else too. If straight-ahead action’s more your thing, keep an eye out for Johnnie To’s Exiled (Bay Area release date unknown). Touted in some circles as the sequel to The Mission, this may be the prolific To’s best gangster movie to date. The smashingly hangdog Anthony Wong anchors a cast of familiar Hong Kong faces (Simon Yam, Francis Ng, Nick Cheung); the plot, about hired guns and gangsters who do the double cross like nobody’s business, matters less than the jaw-dropping gun battles it produces. When shoot-outs come this well choreographed, the word is gun-fu — and in Exiled, the bloody results are nothing short of stunning. Also topping my Toronto experience so far: Takashi Miike’s latest oddity, surreal prison drama Big Bang Love: Juvenile A (by the time you read this, he’ll probably already have his next film in the can); The Wayward Cloud director Tsai Ming-liang’s dreamy, gritty, and near-silent I Don’t Want to Sleep Alone; and Nobody Knows helmer Hirokazu Kore-eda’s samurai yarn, Hana. TECHSPLOITATION In honor of George W. Bush’s efforts to stop torture by setting up secret CIA prisons and promote freedom by expanding government surveillance powers, I think we should spend a few days contemputf8g another great thing this administration has done for the world: it has reinvigorated political satire.
What was The Daily Show before the USA PATRIOT Act? And where would international pranksters the Yes Men be today without this administration’s asshattish policies?
Thanks to the Internet, satire can be instant and lethal. Certainly it’s not always pretty, but it’s more effective as social criticism than it was in an era before jesters could respond within hours to current events and broadcast their pranks globally.
I’m still a big fan of the widely condemned fake execution video made by three San Francisco multimedia geeks in 2004. Benjamin Vanderford, who plays experimental music in several bands, decided to make the video in response to the media hysteria around the Nick Berg execution video. He’s said that the video wasn’t a partisan protest of the war itself, but instead a wake-up call to the media, which he criticized on his Web site (videohoax.ctyme.com) for doing “no fact-finding” and being so “centralized” that they’ll reprint anything from Reuters or the Associated Press without verifying it.
With the help of Laurie Kirchner and Robert Martin, Vanderford filmed himself tied up in a dingy room as if he’d been kidnapped in Iraq. He stated his real name and address and urged the United States to get out of Iraq. Islamic chants played in the background, and every few seconds a picture of a grisly execution appeared. “We need to leave this country alone or all of us will die like this,” Vanderford said before the video cut to a grainy image of somebody sawing his head off with a butcher knife.
He and his buddies made the video available on their hard drives to anyone using the P2P networks Kazaa and Soulseek. Because the Berg execution video was all over the news, thousands of people were scouring P2P networks for anything with the word “execution” in the title. The video soon turned up on an Islamic Web site, which is how the US media got wind of it. AP and several papers published stories about the video without ever bothering to look up Vanderford, verify his existence, or check the address he used in the video (which was his real home address).
Sure, the message was ugly and the video is actually quite disturbing to watch. But it was the very best kind of social satire — it proved Vanderford’s point that the media were so eager to lap up any news that could feed the terrorism frenzy that they weren’t bothering to do even the most rudimentary fact-checking. Of course, the news outlets whose shoddy practices had been unmasked by this prank were quick to condemn Vanderford and cover their asses. Fox ran a bogus segment featuring a “legal adviser” who said Vanderford had broken the law (he hadn’t), and AP deputy editor Tom Kent claimed that his organization did eventually check the veracity of the tape by “banging” on Vanderford’s door at 4 a.m. and filming him in his underwear answering questions about the hoax (you can see clips of this seminaked interview online).
Possibly the stupidest responses to the hoax came from people who claimed that it hurt people and therefore Vanderford and pals should be punished. Stanford professor of communications Ted Glasser told the San Jose Mercury News that releasing the video was “like bombing a building to see if security measures are in place.” Despite the foolishness of this comment, it reveals how strongly people are affected by well-aimed satire.
I’d rather watch a dozen fake execution videos if it would make the media more careful about buying into government and corporate propaganda. I live for the day when satire is like bombing a building — because nobody actually bombs anyone anymore.
See, that’s the beauty of satire — it hurts, but only in your conscience. SFBG

The age of 9/11

OPINION We all remember where we were on Sept. 11, 2001. The event rocked the world as the last remaining superpower was attacked in full view of its citizens. The images entered our collective consciousness, and we began a new era of global unrest. The gloves came off, diplomacy was mocked, and the United States blasted onto the world stage, weapons drawn.
Let’s not relive the events of Sept. 11. We have been reminded of that morning over and over as it has become the sole source of George W. Bush’s foreign policy. The international war on terror has taken center stage as Bush and others have used it as a pretext to undermine the pillars of democracy — the rule of law and transparent government. We now take racial profiling for granted. We watch as people are kidnapped from their countries and imprisoned indefinitely. Illegal torture is commonplace, as is the hideous killing of civilians, and now we hear accusations that our soldiers in Iraq seek revenge through rape and murder. We are forced to accept the USA PATRIOT Act and illegal National Security Agency surveillance, supposedly for our own good.
As Bush used Sept. 11 to justify a renewed campaign of imperialist aggression, he also eviscerated social programs at home. He gutted the Federal Emergency Management Agency and placed it under the control of the Department of Homeland Security, leaving us unable to respond adequately to natural disasters. He deployed our National Guard overseas and depleted our treasury to pay for war. He failed to address global warming, in deference to industry supporters. Finally, we have had to let go of the assumption that our government would protect its own people, as we ask: when did the Bush team know about Sept. 11? Will this question take as long to answer as “Who killed JFK?”
Nothing about the Bush regime is working for the average citizen, and yet all of the above have been completely normalized and barely contested by Congress, with hardly a whimper, a press conference, or a filibuster. Five years later, Bush still attempts to build his legacy on the twin towers of fear and aggression, working with the pathological paranoia that has become the hallmark of our 21st-century society.
But five years later, public opinion is reversing. Impeachment, which once seemed as far-fetched as due process for Guantánamo prisoners, has become a rallying cry for the next election. The San Francisco Board of Supervisors recently passed a resolution in support of Bush’s impeachment, and Sup. Chris Daly has sponsored another one, which will appear on the November ballot. They are an important response from the people to a criminal administration and an anemic Congress. If Bill Clinton can be impeached for a sexual indiscretion to the tune of $60 million in tax dollars and Bush gets off scot-free, what are we telling our children? That a blow job is worse than blowing up a country, and that illegal lying and spying play second fiddle to a marital blunder? The Christian fundamentalists who run our country would have us think so.
Vote for Chris Daly’s impeachment resolution. Yes on J! SFBG

TECHSPLOITATION I was in front of a computer when the Twin Towers went down. The morning light flooded Charlie’s tiny studio apartment kitchen, where she’d parked her computer desk in a spot that another person would have used for a breakfast nook.
“Holy shit,” she said. “Look at the Washington Post!” I stared blearily at the monitor, coffee mug in my hand, and saw pictures of smoke. Charlie continued clicking and clicking on news. It was everywhere: live streams and up-to-the-second photographs of the towers as they burned.
One had fallen. Then the other one did. That morning we consumed hundreds of images and lines of electronic text, at the edge of a future I couldn’t fathom. Shit was going to happen, that’s all I knew.
My phone rang an hour later: it was Ed, whose plane from Japan to San Francisco had been diverted to Vancouver. No planes were entering or leaving US airspace.
What happened in geographical space was just the thin end of the wedge.
Shifts more dramatic than anything I could have imagined occurred on our electronic communication networks. The phone system and the Internet formed a new ground zero, a place where “fighting terrorism” became a force more socially disruptive than terrorism itself.
In the weeks that followed, flags and half-baked, vengeful ideas
spattered the mediascape online. ISPs allowed the government to install “carnivore” devices on network backbones, thus allowing the government to eavesdrop on everybody’s Internet traffic. Passage of the USA-PATRIOT Act allowed law enforcement to send secret subpoenas to online service providers for information about their customers.
Those of us critical of the US policies that led to the attack literally whispered to each other about it. We were afraid to say what we thought of the government crackdowns.
Something changed the Internet forever during the surreal years after the attack on the World Trade Center, when we went to war with a country whose citizens and leaders had nothing to do with what happened on September 11, 2001. Data mining was weaponized.
The ability to track hidden information patterns in vast piles of
unsifted data, once the purview of obscure academic articles and some start-ups with weird names like Inktomi and Google, became the touchstone of government efforts to track down terrorists. If a lack of intel is what allowed the terrorists to get us, then by gum, the spooks were going to get as much intel as they possibly could.
As a result, we got John Poindexter pushing misguided programs like Terrorism Information Awareness (TIA), which would allegedly be a giant computer operation in which all the data in the universe would be crunched and “patterns” would emerge to lead government agents to dens of bomb-making bad guys. It also led to the NSA’s now infamous (and probably illegal) surveillance of all the telephone and Internet data passing through AT&T’s wires — as well as the wires of several other major network providers.
Both of these programs rely on the idea that you can find a terrorist
needle in a haystack of data. And both were made far more dangerous by the rise of consumer products like Gmail, Flickr, and MySpace — giant databases of personal information, often tagged with keywords for easy searching. As many pundits (including myself) have said, we’re creating our own surveillance treasure trove.
But what that analysis leaves out is something near and dear to the
American spirit: the people have weapons too. It isn’t just the
government that can turn data mining into a weapon. The citizens can do it too, often better. And so the years since the Sept. 11 attacks have witnessed a blooming of what Dan Gillmor calls “citizen journalism.”
When the mainstream media wouldn’t report what was going on, people turned to alternative sources of news, including online sources. Bloggers became the new investigative reporters.
The groundwork laid by these subversive data miners continues today. The community of online journalists and researchers revealed that an AP photo of the fires in Beirut had been doctored. Bloggers sounded the alarm when upstart photographer Josh Wolf was arrested for refusing to hand over to police video he’d taken of a G-8 protest in San Francisco.
It’s no accident that the rise of blogging coincides with the rise of
government surveillance online. The people are watching too. SFBG

Last month, two news stories broke the same day, one meaty, one junky. In Detroit, US District Judge Anna Diggs Taylor ruled that the Bush administration’s warrantless National Security Agency surveillance program was unconstitutional and must end. Meanwhile, somewhere in Thailand, a weirdo named John Mark Karr claimed he was with six-year-old beauty queen JonBenet Ramsey when she died in 1996.
Predictably, the mainstream media devoted acres of newsprint and hours of airtime to the self-proclaimed beauty queen killer, including stories on what he ate on the plane ride home, his desire for a sex change, his child-porn fixation, and — when DNA tests proved Karr wasn’t the killer — why he confessed to a crime he didn’t commit.
During that same time period, hardly a word was written or said in the same outlets about Judge Diggs Taylor’s ruling and the question it raises about why Bush and his power-grabbing administration repeatedly lie to the American public.
The mainstream media’s fascination with unimportant stories isn’t anything new. Professor Carl Jensen, a disenchanted journalist who entered advertising only to walk away in greater disgust and become a sociologist, says the media’s preoccupation with “junk food news” inspired him to found a media research project at Sonoma State University about 30 years ago to publicize the top 25 big stories the media had censored, ignored, or underreported the previous year.
That was the beginning of Project Censored, the longest-running media censorship project in the nation — and it drew plenty of criticism from editors and publishers.
“I was taking a lot of flak from editors around Project Censored’s annual list of the top stories the mainstream media missed,” recalls the now-retired Jensen. “They said the reason they hadn’t covered the stories was that they only had a limited amount of time and space, and that I was an academic, sitting there criticizing.”
But Jensen had an answer: there was plenty of time and space, but it was just being filled with fluff.
Since 1993, Project Censored has been running not only the stories that didn’t get adequate coverage but also the “junk food news” — the stories that were way, way overblown and filled precious pages and airtime that could have been used for real news.
While Jensen would love to be able to claim that Project Censored solved the media’s problems with censorship and junk food news, that didn’t happen.
“If anything, it’s gotten worse,” Jensen says, pointing to increased media monopolization.
Project Censored’s current director, Peter Phillips, says entertainment news may be addictive, but that’s no excuse for the media to push it.
“Massacres, celebrity gossip — we’re automatically attracted,” Phillips says. “It’s like selling drugs. But we don’t tolerate the drug dealer on the corner. For the democratic process to happen, we have to have information presented and made available. To just give people entertainment news is an abdication of the First Amendment.”
Art Brodsky, a telecommunications expert at Public Knowledge, an advocacy group based in Washington, DC, says some of the problems with censorship are a product of journalistic laziness. Brodsky, who has written extensively on network neutrality, which is the number one issue on this year’s list, says the topic hasn’t received enough coverage, partly because the debate has largely remained couched in telecommunications jargon.
“Network neutralilty is a crappy term, other than its alliterative value,” Brodsky says. “It’s one of those Washington issues that gets intense coverage in the field where it happens but can be successfully muddied, and it’s technical. So a lot of editors and reporters throw their hands up in the air, a lot like senators.
Following are Project Censored’s top 10 stories for the past year.
1. THE FEDS AND THE MEDIA MUDDY THE DEBATE OVER INTERNET FREEDOM
In its relatively brief life, the Internet has been touted as the greatest vehicle for democracy ever invented by humankind. It’s given disillusioned Americans hope that there is a way to get out the truth, even if they don’t own airwaves, newspapers, or satellite stations. It’s forced the mainstream media to talk about issues it previously ignored, such as the Downing Street memo and Abu Ghraib prisoner abuse.
So when the Supreme Court ruled that giant cable companies aren’t required to share their wires with other Internet service providers, it shouldn’t have been a surprise that the major media did little in terms of exploring whether this ruling would destroy Internet freedom. As Elliot Cohen reported in BuzzFlash, the issue was misleadingly framed as an argument over regulation, when it’s really a case of the Federal Communications Commission and Congress talking about giving cable and telephone companies the freedom to control supply and content — a decision that could have them playing favorites and forcing consumers to pay to get information and services that currently are free.
The good news? With the Senate still set to debate the Communications Opportunity, Promotion and Enhancement Act of 2006, as the network neutrality bill is called, it’s not too late to write congressional representatives, alert friends and acquaintances, and join grassroots groups to protect Internet freedom and diversity.

2. HALLIBURTON CHARGED WITH SELLING NUCLEAR TECHNOLOGY TO IRAN
Halliburton, the notorious US energy company, sold key nuclear reactor components to a private Iranian oil company called Oriental Oil Kish as recently as 2005, using offshore subsidiaries to circumvent US sanctions, journalist Jason Leopold reported on GlobalResearch.ca, the Web site of a Canadian research group. He cited sources intimate with the business dealings of Halliburton and Kish.
The story is particularly juicy because Vice President Dick Cheney, who now claims to want to stop Iran from getting nukes, was president of Halliburton in the mid-1990s, at which time he may have advocated business dealings with Iran, in violation of US law.
Leopold contended that the Halliburton-Kish deals have helped Iran become capable of enriching weapons-grade uranium.
He filed his report in 2005, when Iran’s new hard-line government was rounding up relatives and business associates of former Iranian president Hashemi Rafsanjani, amid accusations of widespread corruption in Iran’s oil industry.
Leopold also reported that in 2004 and 2005, Halliburton had a close business relationship with Cyrus Nasseri, an Oriental Oil Kish official whom the Iranian government subsequently accused of receiving up to $1 million from Halliburton for giving them Iran’s nuclear secrets.

3. WORLD OCEANS IN EXTREME DANGER
Rising sea levels. A melting Arctic. Governments denying global warming is happening as they rush to map the ocean floor in the hopes of claiming rights to oil, gas, gold, diamonds, copper, zinc, and the planet’s last pristine fishing grounds. This is the sobering picture author Julia Whitty painted in a beautifully crafted piece that makes the point that “there is only one ocean on Earth … a Mobiuslike ribbon winding through all the ocean basins, rising and falling, and stirring the waters of the world.”
If this world ocean, which encompasses 70.78 percent of our planet, is in peril, then we’re all screwed. As Whitty reported in Mother Jones magazine, researchers at the Scripps Institution of Oceanography and the Lawrence Livermore National Laboratory in 2005 found “the first clear evidence that the world ocean is growing warmer,” including the discovery “that the top half-mile of the ocean has warmed dramatically in the past 40 years as the result of human-induced greenhouse gases.” But while a Scripps researcher recommended that “the Bush administration convene a Manhattan-style project” to see if mitigations are still possible, the US government has yet to lift a finger toward addressing the problem.

4. HUNGER AND HOMELESSNESS INCREASING IN THE UNITED STATES
As hunger and homelessness rise in the United States, the Bush administration plans to get rid of a data source that supports this embarrassing reality — a survey that’s been used to improve state and federal programs for retired and low-income Americans.
President Bush’s proposed budget for fiscal year 2007 includes an effort to eliminate the Census Bureau’s Survey of Income and Program Participation. Founded in 1984, the survey tracks American families’ use of Social Security, Medicaid, unemployment insurance, child care, and temporary assistance for needy families.
With legislators and researchers trying to prevent the cut, author Abid Aslam argued that this isn’t just an isolated budget matter: it’s the Bush administration’s third attempt in as many years to remove funding for politically embarrassing research. In 2003, it tried to whack the Bureau of Labor Statistics report on mass layoffs and in 2004 and 2005 attempted to drop the bureau’s questions on the hiring and firing of women from its employment data.

5. HIGH-TECH GENOCIDE IN CONGO
If you believe the corporate media, then the ongoing genocide in the Democratic Republic of the Congo is all just a case of ugly tribal warfare. But that, according to stories published in Z Magazine and the Earth First! Journal and heard on The Taylor Report, is a superficial, simplistic explanation that fails to connect this terrible suffering with the immense fortunes that stand to be made from manufacturing cell phones, laptop computers, and other high-tech equipment.
What’s really at stake in this bloodbath is control of natural resources such as diamonds, tin, and copper, as well as cobalt — which is essential for the nuclear, chemical, aerospace, and defense industries — and coltan and niobium, which is most important for the high-tech industries. These disturbing reports concluded that a meaningful analysis of Congolese geopolitics requires a knowledge and understanding of the organized crime perpetuated by multinationals.

6. FEDERAL WHISTLEBLOWER PROTECTION IN JEOPARDY
Though record numbers of federal workers have been sounding the alarm on waste, fraud, and other financial abuse since George W. Bush became president, the agency charged with defending government whistleblowers has reportedly been throwing out hundreds of cases — and advancing almost none. Statistics released at the end of 2005 by Public Employees for Environmental Responsibility led to claims that special counsel Scott Bloch, who was appointed by Bush in 2004, is overseeing the systematic elimination of whistleblower rights.
What makes this development particularly troubling is that, thanks to a decline in congressional oversight and hard-hitting investigative journalism, the role of the Office of Special Counsel in advancing governmental transparency is more vital than ever. As a result, employees within the OSC have filed a whistleblower complaint against Bloch himself.
Ironically, Bloch has now decided not to disclose the number of whistleblower complaints in which an employee obtained a favorable outcome, such as reinstatement or reversal of a disciplinary action, making it hard to tell who, if anyone, is being helped by the agency.

7. US OPERATIVES TORTURE DETAINEES TO DEATH IN AFGHANISTAN AND IRAQ
Hooded. Gagged. Strangled. Asphyxiated. Beaten with blunt objects. Subjected to sleep deprivation and hot and cold environmental conditions. These are just some of the forms of torture that the US military in Iraq and Afghanistan inflicted on detainees, according to an American Civil Liberties Union analysis of autopsy and death reports that were made public in response to a Freedom of Information Act lawsuit.
While reports of torture aren’t new, the documents are evidence of using torture as a policy, raising a whole bunch of uncomfortable questions, such as: Who authorized such techniques? And why have the resulting deaths been covered up?
Of the 44 death reports released under ACLU’s FOIA request, 21 were homicides and eight appear to have been the result of these abusive torture techniques.

8. PENTAGON EXEMPT FROM FREEDOM OF INFORMATION ACT
In 2005, the Department of Defense pushed for and was granted exemption from Freedom of Information Act requests, a crucial law that allows journalists and watchdogs access to federal documents. The stated reason for this dramatic and dangerous move? FOIA is a hindrance to protecting national security. The ruling could hamper the efforts of groups like the ACLU, which relied on FOIA to uncover more than 30,000 documents on the US military’s torture of detainees in Afghanistan, Iraq, and Guantánamo Bay, including the Abu Ghraib torture scandal.
With ACLU lawyers predicting that this ruling will likely result in more abuse and with Americans becoming increasingly concerned about the federal government’s illegal intelligence-gathering activities, Congress has imposed a two-year sunset on this FOIA exemption, ending December 2007 — which is cold comfort right now to anyone rotting in a US overseas military facility or a secret CIA prison.

9. WORLD BANK FUNDS ISRAEL-PALESTINE WALL
In 2004, the International Court of Justice ruled that the wall Israel is building deep into Palestinian territory should be torn down. Instead, construction of this cement barrier, which annexes Israeli settlements and breaks the continuity of Palestinian territory, has accelerated. In the interim, the World Bank has come up with a framework for a Middle Eastern Free Trade Area, which would be financed by the World Bank and built on Palestinian land around the wall to encourage export-oriented economic development. But with Israel ineligible for World Bank loans, the plan seems to translate into Palestinians paying for the modernization of checkpoints around a wall that they’ve always opposed, a wall that will help lock in and exploit their labor.

10. EXPANDED AIR WAR IN IRAQ KILLS MORE CIVILIANS
At the end of 2005, US Central Command Air Force statistics showed an increase in American air missions, a trend that was accompanied by a rise in civilian deaths thanks to increased bombing of Iraqi cities. But with US bombings and the killing of innocent civilians acting as a highly effective recruiting tool among Iraqi militants, the US war on Iraq seemed to increasingly be following the path of the war in Vietnam. As Seymour Hersh reported in the New Yorker at the end of 2005, a key component in the federal government’s troop-reduction plan was the replacement of departing US troops with US air power.
Meanwhile, Hersh’s sources within the military have expressed fears that if Iraqis are allowed to call in the targets of these aerial strikes, they could abuse that power to settle old scores. With Iraq devolving into a full-blown Sunni-Shiite civil war and the United States increasingly drawn into the sectarian violence, reporters like Hersh and Dahr Jamail fear that the only exit strategy for the United States is to increase the air power even more as the troops pull out, causing the cycle of sectarian violence to escalate further.

TECHSPLOITATION Last night, for about the 30,000th time, I pondered whether I should be shredding the stubs of my phone and cable bills before throwing them away. I always keep my credit card statements for a year or two. That shit just seems too scary personal to toss. But what about the other stuff? If someone were to root through my building’s trash bin and find my (unshredded) cell phone bill, they’d know the numbers of everyone I’d called during the past month. Other bill stubs are less revelatory, but someone could still use them to cancel my gas and electricity or order me the most expensive cable package.
But I just can’t muster up the amount of paranoia that would be required to properly eliminate all those pieces of paper with my personally identifiable information on them. And good shredders (not the lame one-sheet-at-a-time ones) are expensive. So every month I leave massive amounts of personal data in the bins outside my back door.
And that’s not all. I also save chat sessions on my computer and SMS messages on my phone. Sure, I fear clutter in the real world, but I also have a highly developed sense of sentimental value. So I keep the little electronic blips my friends write, thinking that one day I’ll be glad to read them again. Some of those blips are e-mails that I keep stored in the vast server fields of a major Web mail provider, which means that system administrators can look at them — and worse, this Web mail provider can hand them over to the government without telling me.
Don’t even get me started on the kinds of personal information I leak about myself in my writing. A dedicated asswipe could, just by combing over my old columns, figure out the general location of my house in San Francisco, my sexual orientation, the kind of relationship I’m in, what kind of computer I have, which ISP I use, where I’ve worked, where I shop, and who my friends are.
All my digital data is, of course, far more vulnerable than those hard copy phone records I dump every month. At least my trash bin is localized: to steal or tamper with my information, somebody would have to break into my building and jump inside the trash bin. But to steal my e-mail? Or read my columns obsessively for personal details? A naughty person could do that from anywhere. Prying members of an HR department could run a background check on me from the comfort of their Aeron chairs.
So what the hell is wrong with me? Why would I compromise my own privacy, knowing full well what the consequences could be? I’ve already confessed to a few reasons: laziness, inability to hoard tiny pieces of paper, sentimentality, chronic column writing. The less frivolous answer is that I’ve weighed the alternatives — shredders, constant data wiping — and chosen to take the risk. I don’t want to be forced to hide everything about myself. If some potential employer doesn’t like my blog, that’s an employer I don’t need. If the government wants to persecute me for what’s contained in my stored messages, then I will fight back as best I can or leave the country.
It’s not as if I don’t protect myself. I never store any data in my Web mail account that I’m not prepared to share with sysadmins and the government. I overwrite data that I want to delete on my computer, which means it can’t be retrieved using typical law enforcement forensics. I rarely enter anything but fake information into online forms. I download and send my e-mail via SSL, which prevents people from reading it while it’s moving over the network. Am I safe from the National Security Agency or a very determined hacker? No. But neither am I leaving myself wide open to identity theft and surveillance.
When somebody breaks into your computer and looks at your private data, geeks say that your computer has been “owned.” And if your computer is utterly taken over, all its information plundered egregiously, you’ve been “pwned” — a bit of geek slang that comes from some dork who made a typo on IRC back in the day. I know that I’m pwned by the government, pwned by Google, pwned by my reliance on Windows OS. But they haven’t pwned my brain, OK? I’m still going to write the truth about myself and the world; I’m still going to throw away bill stubs like a normal person.
Say it loud and clear: we will not be pwned! If that isn’t a 21st-century protest cry, I don’t know what is. SFBG

The flaws in the Josh Wolf case

Last week the California State Assembly and Senate unanimously asked Congress to pass a federal shield law to protect journalists from being forced to disclose unpublished material and the identity of a source.
Part of the motivation for the new push for federal legislation is the recent spate of federal attempts to imprison journalists who won’t give up their confidential sources. The latest victim of that crackdown, Josh Wolf, is in federal confinement after refusing to give prosecutors outtakes from a video he shot of a demonstration at which a San Francisco police officer was injured and a taillight was broken on a cop car (see “The SFPD’s Punt,” 8/23/06).
And while Congress is reviewing the case for protecting journalists, the Guardian has taken a hard look at the case against Josh Wolf — and it’s looking more dubious every day.
For starters, the local cops and the federal prosecutors are trying to claim that Wolf isn’t really a reporter.
That’s what sources in the San Francisco Police Department and the US Attorney’s Office tell us, and it’s borne out by the way the feds are pressing their case in court. In legal briefs, the government never refers to Wolf as a journalist, only as a witness. One federal official, who spoke on the condition he not be identified, likened Wolf to a convenience store owner who has a security camera that catches criminal activity on tape.
There are all sorts of problems with this argument — the first being that the courts have never formally contested Wolf’s journalistic credentials. In fact, the local prosecutors admit in legal briefs that they contacted Washington to seek permission to subpoena Wolf — a process that’s required whenever journalists face this sort of legal action.
As Peter Scheer of the California First Amendment Coalition points out, “The Justice Department claims it complied with regulations that say you can’t subpoena a journalist for outtakes without getting a special order from the attorney general.”
Scheer also notes that under California law, even bloggers enjoy the reporter’s privilege, as recently established when Apple Computer unsuccessfully tried to obtain the identities of sources who allegedly leaked business secrets to bloggers.
Lucy Dalglish, executive director of the Virginia-based Reporters Committee for Freedom of the Press, says that a case for Wolf qualifying as a journalist could be made under both the House and Senate versions of the Free Flow of Information Act, simply because Wolf was paid for broadcasting his video of the protest.
“In the Senate version, you have to be involved in journalism for money, make some part of your livelihood from it, while the House version is even broader,” said Dalglish.
Watching the part of Wolf’s video that he’s made public, which is posted online at www.joshwolf.net and was aired without his consent by at least three major TV networks before he was eventually compensated, it’s easy to speculate that the SFPD would not have delighted in the picture it paints of local law enforcement.
The footage of the July 8, 2005, protest begins peacefully with protesters, many of them wearing black ski masks, carrying banners saying “Anarchist Action,” “War is the Symptom, Capitalism is the Disease,” and “Destroy the War Machine.” As night comes on, the mood sparkles, then darkens. Someone lights a firecracker, smoke rises, helmeted police arrive, newspaper boxes are turned over, a Pacific Gas and Electric Co. office is sprayed with paint, and suddenly a police officer is captured holding a protester in what appears to be a choking position, while someone shouts, “Police brutality! Your career is over, fajita boy!” and an officer warns, “Leave or you’re going to get blasted. I’m a fed, motherfucker.”
At the same demonstration, Officer Peter Shields was hit in the head while charging into a crowd of protesters — and nobody knows exactly who hit him. That’s not on the public part of Wolf’s video, and Wolf and his lawyers insist there is no footage of the attack. Wolf fears that the government may be looking for something else — perhaps some video of other protesters — and will ask him to identify them. He refused to turn over the outtakes.
Carlos Villarreal, executive director of the National Lawyers Guild, says District Court Judge William Alsup, who ordered Wolf to jail, “made a big deal that Josh did not have agreement with a confidential source, but his argument turns Josh’s video equipment into a de facto government surveillance camera.”
Noting that there is a lot of trust between Wolf and protesters at demonstrations — “People aren’t afraid to go up to the camera and say, ‘Did you check out the pig that’s kicking a guy down the street?’” — Villarreal claims that “independent journalists are harder to see and spot than their corporate counterparts.”
The second, perhaps equally troubling problem is that the Wolf case should never have gone to the federal level in the first place.
Alan Schlosser, legal director of the American Civil Liberties Union of Northern California, told us there are a lot of red flags in the Wolf case, “beginning with the question, ‘Is there a legitimate federal law enforcement issue here?’”
The federal agents from the Joint Terrorism Task Force (JTTF) and the FBI didn’t choose to investigate the case — the San Francisco cops requested assistance. That in itself was odd: why is an assault on an officer a federal affair?
Schlosser asks, “Were the feds called in because they aren’t bound by the state’s reporter’s shield law?”
In theory, the local cops say it’s a federal issue because a cop car was damaged — and the city gets money from the federal government for law enforcement. Schlosser said it’s disturbing that “the SFPD doesn’t have to show the federal funds went towards paying for the allegedly damaged car…. So that statute could be applied to any number of situations. It’s very troubling. It federalizes law enforcement around demonstrations.”
A highly placed source in the SFPD offered a somewhat alarming explanation: the feds were brought in, the source said, not because of shield law issues but because the cops figured the JTTF and the US Attorney’s Office would move faster and more aggressively than San Francisco district attorney Kamala Harris, who has not been on the best terms with the local police.
In other words, if this source is correct, the SFPD is choosing who will prosecute crimes — based on politics, not the law.
As of press time, all Harris’s office was saying was that “the DA strongly believes in the First Amendment and the rights of the press. She also believes in justice for members of the SFPD. An officer was gravely injured that evening, and those responsible need to be held accountable.”
Asked why the federal government was involved in the investigation, Luke Macaulay, a spokesperson for the US Attorney’s Office, said, “This is not an attempt to profile anarchists and dissidents. It’s an attempt to get to the bottom of a crime.”
Macaulay also referred us to federal filings with the US District Court, which conclude that “the issue could not be more straightforward…. The incident is under investigation so that the grand jury can determine what, if any, crimes were committed.”
As far as we can tell, there’s nothing in writing that lays out when a San Francisco cop is allowed to ask for federal intervention in a case. All the SFPD General Orders say is that department members requesting assistance from an outside agency have to obtain the permission of a deputy chief.
According to records from the Investigations Bureau General Work Detail, Inspector Lea Militello filed a request for assistance from the FBI and JTTF to investigate a “serious assault against an SF police officer.” It was approved by Captain Kevin Cashman and Timothy Hettrich, deputy chief of investigations.
As of press time, the SFPD had not returned our calls inquiring why the FBI and JTTF were involved in an assault case, which is usually the domain of the DA’s Office.
David Campos, a member of the San Francisco Police Commission, said he thinks the commission needs to look at the issue “to make sure investigations are federalized when it’s appropriate and not as a way of getting around California’s shield laws.”
Reached Aug. 23 by phone in the Dublin Federal Correctional Institute, where he’s been held since Aug. 1, Wolf suggested that the feds are after more than pictures. “The Un-American Affairs Committee [in the 1950s] called in one person and forced them to make a list of all the people they knew. It was like Communist MySpace. So, I anticipate that they want all my contacts within the civil dissent movement.”
Wolf said he offered to let the judge view his video, which he insists does not capture the arson or assault. “There should not be a federal investigation. I published my video. They can use that to do their investigation.” SFBG

No Pasaran!

MEXICO CITY, Aug. 24th — The Congress of the country is ringed by two-meter tall grilled metal barriers soldered together, apparently to thwart a suicide car-bomb attack. Behind this metal wall, 3000 vizored, kevlar-wearing robocops — the Federal Preventative Police (PFP, a police force drawn from the army) — and members of the elite Estado Mayor or presidential military command, form a second line of defense. Armed with tear gas launchers, water cannons, and reportedly light tanks, this Praetorian Guard has been assigned to protect law and order and the institutions of the republic against left-wing mobs that threaten to storm the Legislative Palace – or so the president informs his fellow citizens in repeated messages transmitted on national television.
No, the president’s name is not Pinochet and this military tableau is not being mounted in the usual banana republic or some African satrap. This is Mexico, a paragon of democracy (dixit George Bush), Washington’s third trading partner, and the eighth leading petroleum producer on the planet, seven weeks after the fraud-marred July 2nd presidential election of which, at this writing, no winner has been officially declared. One of the elite military units assigned to seal off congress is indeed titled the July 2nd brigade.

“MEXICO ON A KNIFEBLADE” headlines the British Guardian. The typically short-term-memory-loss U.S. print media seems to have forgotten about the imbroglio just south of its borders. Nonetheless, the phone rings and it’s New York telling me they just got a call from their man on the border and Homeland Security is beefing up its forces around Laredo in anticipation of upheaval further south. The phone rings again and it’s California telling me they just heard on Air America that U.S. Navy patrols were being dispatched to safeguard Mexican oil platforms in the Gulf. The left-wing daily La Jornada runs a citizen-snapped photo of army convoys arriving carrying soldiers disguised as farmers and young toughs. Rumors race through the seven mile-long encampment installed by supporters of leftist presidential challenger Andres Manuel Lopez Obrador (AMLO) three weeks ago, who have tied up big city traffic and enraged the motorist class here, that PFP robocops will attack before dawn. The campers stay up all night huddled around bum fires prepared to defend their tent cities.

The moment reminds many Mexicans of the tense weeks in September and October 1968 when, 12 days before the Olympic Games were to be inaugurated here, President Gustavo Diaz Ordaz ordered the military to massacre striking students in a downtown plaza not far from where AMLO’s people are now camped out. Some 300 were killed in the Plaza of Three Cultures, their bodies incinerated at Military Camp #1 in western Mexico City. The Tlatelolco massacre was a watershed in social conflict here and the similarities are sinister– in fact, Lopez Obrador has taken to comparing outgoing President Vicente Fox with Diaz Ordaz.

Fox will go to congress September 1st to deliver his final State of the Union address; the new legislature will be convened the same day. The country may or may not have a new president by that day. In anticipation of this show-down, on August 14th, newly-elected senators and deputies from the three parties that comprise AMLO’s Coalition for the Good of All attempted to encamp on the sidewalk in front of the legislative palace only to be rousted and clobbered bloody by the President’s robocops.

With 160 representatives, the Coalition forms just a quarter of the 628 members of the new congress, but its members will be a loud minority during Fox’s “Informe.” Since the 1988 presidenciales were stolen from Cuauhtemoc Cardenas, founder of AMLO’s Party of the Democratic Revolution, PRD legislators have routinely interrupted the president during this authoritarian ritual in orchestrated outbursts that have sometimes degenerated into partisan fisticuffs.

The first to challenge the Imperial Presidency was Porfirio Munoz Ledo, a hoary political warhorse, who in 1988 thrust a finger at President Miguel De la Madrid, accusing him of overseeing the theft of the election from Cardenas. Munoz Ledo’s J’Acuse stunned the political class; he was slugged and pummeled by members of De la Madrid’s long-ruling PRI when he tried to escape the chamber. Munoz Ledo now stands at AMLO’s side.

But perhaps the most comical moment in the annals of acting out during the Informe came in 1996 when a brash PRI deputy donned a Babe the Valiant Pig mask and positioned himself directly under the podium from which President Ernesto Zedillo was addressing the state of the nation and wiggled insouciant signs with slogans that said things like ‘EAT THE RICH!” Like Munoz Ledo, Marco Rascon was physically attacked, his mask ripped off like he was a losing wrestler by a corrupt railroad union official — who in turn was hammer locked by a pseudo-leftist senator, Irma “La Tigresa” Serrano, a one-time ranchero singers and, in fact, the former mistress of Gustavo Diaz Ordaz.

This September 1st, if martial law is not declared and the new Congress dissolved before it is even installed, the PRD delegation — which will no doubt be strip-searched by the Estado Mayor for incriminating banners — is sworn to create a monumental ruckus, shredding the tarnished decorum of this once-solemn event forever to protest Fox’s endorsement of electoral larceny. Some solons say they may go naked.

But no matter what kind of uproar develops, one can be secure that it will not be shown on national television, as the cameras of Mexico’s two-headed television monstrosity Televisa and TV Azteca will stay trained on the President as he tries to mouth the stereotypical cliches that is always the stuff and fluff of this otherwise stultifying seance. The images of the chaos on the floor of congress will not be passed along to the Great Unwashed.

NO PASARAN!

There is a reptilian feel to Mexico seven weeks after a discredited Federal Electoral Institute (IFE) cemented Lopez Obrador into a second place coffin by awarding the presidency to right-winger Felipe Calderon by a mere 243,000 votes out of a total 42,000,000 cast. Both Calderon and IFE czar Luis Carlos Ugalde (Calderon was best man at Ugalde’s wedding) make these little beady reptile eyes as they slither across national screens.

Those screens have been the scenes of some of the slimiest and most sordid political intrigue of late. One of the lizard kings who is fleetingly featured on Televisa primetime is an imprisoned Argentinean construction tycoon, Carlos Ahumada, who in 2004 conspired with Fox, Calderon’s PAN, and Televisa to frame AMLO on corruption charges and take him out of the presidential election. El Peje” (for a gar-like fish from the swamps of Lopez Obrador’s native Tabasco) was then leading the pack by 18 points.

Charged by Lopez Obrador, then the mayor of this megalopolis, with defrauding Mexico City out of millions, Ahumada had taken his revenge by filming PRD honchos when they came to his office to pick up boodles of political cash for his lover, Rosario Robles, who aspired to be queen of the PRD. Although the filthy lucre was perfectly legal under Mexico’s milquetoast campaign financing laws, the pick-ups looked awful on national television — AMLO’s former personal secretary was caught stuffing wads of low denomination bills into his suit coat pockets as if he were on Saturday Night Live.

Ahumada subsequently turned the tapes over to the leprous, cigar-chomping leader of Fox’s PAN party in the Senate, Diego Fernandez de Cevallos (“El Jefe Diego”) who in turn had them delivered to a green-haired clown, Brozo, who was then reading the morning news on Televisa. Then the Argentine fled to Cuba in a private plane. Televisa would air the incriminating videos day and night for months.

Apprehended in Veradero after his lover Robles was shadowed to the socialist beachfront, Ahumada spilled the beans to Cuban authorities: Interior Secretary Santiago Creel, who was then AMLO’s lead rival for the presidency, had cooked up the plot with the connivance of reviled former president Carlos Salinas, Lopez Obrador’s most venomous foe, the then attorney general, and Fox himself, to remove AMLO from the race.

The Mexican government did not ask for extradition and Ahumada’s deportation from Cuba was not seen as a friendly gesture. Within a month, diplomatic relations between Mexico and that red paradise were broken off and ambassadors summoned home. The construction tycoon has been imprisoned in Mexico City ever since he was booted out of Cuba, and was last heard from when he had his rogue cop chauffer shoot up the family SUV, a charade both Fox and Televisa tried to pin on AMLO — Ahumada had suggested he was about to release two more incriminating videos. These dubious events took place on June 6th, the day of a crucial presidential debate between AMLO and Calderon.

Then last week, Ahumada abruptly resurfaced — or at least his videotaped confession to Cuban authorities did. Filmed through prison bars, he lays out the plot step by step. Yes, he affirms, the deal was fixed up to cut AMLO’s legs out from under him and advance the fortunes of the right-wing candidate who turned out to be Felipe Calderon and not the bumbling Creel. The conspiracy backfired badly as his supporters rallied around him and Lopez Obrador’s ratings soared.

The origins of the confession tape, leaked to top-rung reporter Carmen Aristegui, was obscure. Had Fidel dispatched it from his sick bed to bolster Lopez Obrador’s claims of victory as the PAN and the snake-eyed Televisa evening anchor Joaquin Lopez Dorriga hissed? The air grew serpentine with theories. There was even one school that speculated Calderon himself had been the source in a scheme to distance himself from Fox (there had always been “mala leche” between them) and Creel, now the leader of the PAN faction in congress.

AMLO advanced a variant of this explanation — the specter of Ahumada had been resuscitated to divert attention from the evidence of generalized fraud the Coalition had submitted to the TRIFE and the panel’s impending verdict that Calderon had won the election.

Perhaps the most nagging question in this snakepit of uncertainty is what happened during the partial recount of less than 10% of the 130,000 ballot boxes ordered by the TRIFE to test the legitimacy of the IFE’s results. Although the recount concluded on August 13th, the judges have released no numbers and are not obligated to do so — their only responsibility is to certify the validity of the election.

Although AMLO’s reps in the counting rooms came up with gobs of evidence — violated ballot boxes, stolen or stuffed ballots, altered tally sheets and other bizarre anomalies — only the left-wing daily La Jornada saw fit to mention them. The silence of the Mexican media and their accomplices in the international press in respect to the Great Fraud is deafening — although they manage to fill their rags with ample attacks on Lopez Obrador for tying up Mexico City traffic.

According to AMLO’s people, 119,000 ballots in the sample recount cannot be substantiated — in about 3500 casillas, 58,000 more votes were cast than the number of voters on the voting list. In nearly 4,000 other casillas, 61,000 ballots allocated to election officials cannot be accounted for. The annulment of the casillas in which these alterations occurred would put Lopez Obrador in striking distance of Calderon and in a better world, would obligate the TRIFE to order a total recount.

But given the cheesy state of the Mexican judiciary this is not apt to happen; one of the judges who will decide the fate of democracy in Mexico is a former client of El Jefe Diego for whom the PANista senator won millions from the Mexico City government in a crooked land deal.

Meanwhile, thousands continue to camp out in a hard rain for a third week on the streets of Mexico City awaiting the court’s decision. They have taken to erecting shrines and altars and are praying for divine intervention. Hundreds pilgrimage out to the shrine of the Virgin of Guadalupe, some crawling on their knees, to ask the Brown Madonna to work her mojo. “God doesn’t belong to the PAN!” they chant as they trudge up the great avenue that leads to the Basilica. “AMLO deserves a miracle” Esther Ortiz, a 70 year-old great grandmother comments to a reporter as she kneels to pray before the gilded altar.

At the Metropolitan Cathedral on one flank of the Zocalo, a young worshipper interrupts Cardinal Norberto Rivera with loas to AMLO and is quickly hustled off the premises by the Prelate’s bouncers. The following Sunday, the Cathedral’s great doors are under heavy surveillance, and churchgoers screened for telltale signs of devotion to Lopez Obrador. Hundreds of AMLO’s supporters mill about in front of the ancient temple shouting “voto por voto” and alleging that Cardinal Rivera is a pederast.

AMLO as demi-god is one motif of this religious pageant being played out at what was once the heart of the Aztec theocracy, the island of Tenochtitlan. The ruins of the twin temples of the fierce Aztec war god Huitzilopochtli and Tlahuac, the god of the rain, is adjacent to the National Palace against which AMLO’s stage is set. Lopez Obrador sleeps each night in a tent close by.

Many hearts were ripped out smoking on these old stones and fed to such hungry gods before the Crusaders showed up bearing the body and blood of Jesus Christ.

AMLO is accused by right-wing “intellectuals” (Enrique Krauze and the gringo apologist George Grayson) of entertaining a Messiah complex. Indeed, he is up there every day on the big screen, his craggy features, salt and pepper hair, raspy voice and defiantly jutted jaw bearing more of a passable resemblance to a younger George C. Scott rather The Crucified One. AMLO’s devotees come every evening at seven, shoehorned between the big tents that fill the Zocalo, rain or shine. Last Monday, I stood with a few thousand diehards in a biblical downpour, thunder and lightening shattering the heavens above. “Llueve y llueve y el pueblo no se mueve” they chanted joyously, “it rains and rains and the people do not move.”

The evolution of these incantations is fascinating. At first, the standard slogan of “Voto Por Voto, Casilla por Casilla!” was automatically invoked whenever Lopez Obrador stepped to the microphone. “You are not alone!” and “Presidente!” had their moment. “Fraude!” is still popular but in these last days, “No Pasaran!” — they shall not pass, the cry of the defenders of Madrid as Franco’s fascist hordes banged on the doors of Madrid, 1936 — has flourished.

In this context, “No Pasaran!” means “we will not let Felipe Calderon pass to the presidency.” AMLO, who holds out little hope that the TRIFE will decide in his favor, devotes more time now to organizing the resistance to the imposition of Calderon upon the Aztec nation. Article 39 of the Mexican constitution, he reminds partisans, grants the people the right to change their government if that government does not represent them. To this end, he is summoning a million delegates up to the Zocalo for a National Democratic Convention on Mexican Independence Day September 16th, a date usually reserved for a major military parade.

Aside from the logistical impossibility of putting a million citizens in this Tiananmen-sized plaza, how this gargantuan political extravaganza is going to be financed is cloudy. Right now, it seems like small children donating their piggy banks is the main mode of fund-raising. Because AMLO’s people distrust the banks, all of which financed Calderon’s vicious TV ad campaign, a giant piggy bank has been raised in the Zocalo to receive the contributions of the faithful.

Dreaming is also a fundraiser. Some 10,000 raised their voices in song this past Sunday as part of a huge chorus assembled under the dome of the Monument to the Revolution to perform a cantata based on the words of Martin Luther King and Mohandas Gandhi. This too is a form of civil resistance, Lopez Obrador commended his followers.

The first National Democratic Convention took place behind rebel lines in the state of Aguascalientes in 1914 at the apogee of the Mexican Revolution when the forces of Francisco Villa and his Army of the North first joined forces with Zapata’s Liberating Army of the Southern Revolution. The second National Democratic Revolution took place 80 years later in 1994, in a clearing in the Lacandon Jungle of Chiapas when the Zapatista Army of National Liberation wedded itself to the civil society in an uprising that rocked Mexico all throughout the ’90s; eclipsed by events, the EZLN and its quixotic spokesperson Subcomandante Marcos have disappeared from the political map in the wake of the fraudulent election.

What this third National Democratic Convention is all about is now being debated in PRD ruling circles and down at the grassroots. Minimally, a plan of organized resistance that will dog Felipe Calderon for the next six years, severely hampering his ability to rule will evolve from this mammoth conclave. The declaration of a government in resistance headed by Andres Manuel Lopez Obrador is one consideration. The National Democratic Convention could also result in the creation of a new party to replace a worn-out PRD now thoroughly infiltrated by cast-offs from the PRI.

The Party of the Democratic Revolution has always functioned best as an opposition party. With notable exceptions (AMLO was one), when the PRD becomes government, it collapses into corruption, internecine bickering, and behaves just as arrogantly as the PAN and the PRI. No Pasaran?

Seven weeks after the July 2nd electoral debacle, Mexico finds itself at a dangerously combustible conjunction (“coyuntura”) in which the tiny white elite here is about to impose its will upon a largely brown and impoverished populous to whom the political parties and process grow more irrelevant each day. “No Pasaran!” the people cry out but to whom and what they are alluding to remains to be defined.

TECHSPLOITATION Last week AOL did another stupid thing, but at least it was in the name of science. The giant Web portal released a data chunk containing three months’ worth of queries to its search engine taken from roughly half a million users. Gathered during the months of March, April, and May, the data shows queries, their date and time, and which Web sites the user ultimately visited. The idea was that this information might be of some use to researchers.
To protect user privacy, AOL replaced the log-in names of searchers with numbers. So you could still see everything that searcher #4356 looked for, but you wouldn’t know who #4356 was, except for one problem: it’s incredibly easy to figure out who people are based on their searches, because they tend to look for themselves, family members, and things in their immediate geographical vicinity. The New York Times did a great story in which reporters examined searches done by user #4417749 and within hours managed to locate their author, a nice old lady in Georgia who now plans to cancel her AOL subscription.
Bloggers and privacy advocates have pointed out that the information AOL released contains more than just the online search patterns of innocent Georgia ladies. It’s unclear what law enforcement might do with the thousands of searches for illegal drugs and pornography. It’s equally unclear what the feds will make of the handful of searches for “Muslim death rituals,” “Muslim brotherhood,” and “Islamic militant web forums.” In a nation where the government is seriously contemputf8g blanket warrants for online surveillance, it’s hard to imagine there aren’t law enforcement types combing this treasure trove of prepackaged personal data. Imagine getting enough dirt on somebody to haul him or her in for questioning just by downloading 400 megabytes of stuff from AOL! That’s like free candy.
After public outcry reached a crescendo, AOL apologized and took the data down. Of course, privacy advocates like the Electronic Privacy Information Center’s Marc Rotenberg and the Electronic Frontier Foundation’s Kurt Opsahl remain pissed off. Why? Because this is the Interweb, folks. Data never dies here. In fact, you can search the records yourself via Dontdelete.com.
Once I visited Don’t Delete, I couldn’t leave. There’s a button you can click to get the search terms from a random user, and every time I hit it, I got another gem. My favorite was user #4206444, obviously a college student trying to cheat quickly on his or her exams in order to get around to the more important things in life. Search phrases like “does social darwinism persist in social welfare policies and in the attitudes of the general public about social welfare” were followed by “free essays on adolescent depression and suicide risks” and “free essays on Charles Dickens Hard Times.” In between these queries were hundreds for “sailor moon pictures,” “pokemon pictures,” “sonic x,” and “selena pictures.”
As blogger Thomas Claburn (www.lot49.com) points out, there’s a kind of poetry to some of the queries. He excerpts a dozen lines from the 8,200 queries made by user #23187425, all of which seem to be a sort of conversation this person was having with the search engine — he or she never actually clicked on any links but just kept querying with plaintive phrases like “i have had trouble,” “i want to change,” and “i know who i am.”
I’m torn. I love having access to this data, both for its touching human qualities and for the kinds of anthropological information it could yield. But as someone who believes strongly in digital privacy, I simply can’t sanction what AOL did. It would be different if I had faith that discovering all those porn searches would somehow inspire people to accept that sexual curiosity is normal. And it would be different if I thought that law enforcement would consider that the people searching for “Islamic militant web forums” might simply be trying to understand the world. But I don’t. This data will be used to “prove” that the Internet is crawling with child pornographers and terrorists.
Someday AOL’s information should be put into the public domain for anthropologists and cultural researchers of the future. That future, however, is probably decades if not a century away. The data is too close to us now — too easily weaponized. Nevertheless, I hold out hope that one day our search queries will illuminate us and provide for another generation a digital outline of our daily desires. SFBG

Keeping it hyperreal

It’s our bright and hazy fortune to be living in an age in which each day presents some new means of communicating with one another. So why does life itself come to feel ever more atomized, more suffocating, more confusing and lonely? Can it really be true that no man is poor who has Friendster?
Remote, the latest multimedia performance piece from partners Sara Kraft and Ed Purver, explores this distance, this ambivalence inside our desire to connect with one another amid proliferating technologies of communication and control. With performers Ernie Lafky and Rowena Richie, Kraft and Purver use a keen assemblage of live video feed, video-based art (all of it mixed live by Purver), Internet hookups, exuberant performance, and music to present a dispersed series of “lab studies.” These run the gamut from everyday text messaging between a bicoastal couple (Kraft and Purver) to the deeply ominous if also comical attempts by the US government in the 1970s to harness paranormal psychic phenomena for use by its military and intelligence apparatus.
This latter dimension of Remote’s evocative archaeology takes the mediation of everyday life in its most overtly sinister direction. Based on extensive research, including use of declassified CIA documents and interviews with key participants, Remote pursues its themes through the belly of the beast — in real-life programs and experiments (reproduced in various cunning and wry ways here) that had bruised military careerists attempting to walk through walls, would-be “psi warriors” trying to implode goats with bursts of psychic energy, and intel gatherers vigorously massaging their temples in an effort to peep into far-flung corners of the globe without leaving the office. (These strategies have since been made unnecessary by new technologies of remote surveillance and destruction — a point underscored in Remote by ghostly infrared images associated with the military’s remote human targeting.)
Moreover, as in the path they cut with 2002’s Woods for the Trees, Kraft and Purver pursue Remote’s themes through the prism of their own relationship — which came eerily to resemble the project they had already begun when Purver relocated to New York. Presenting their lives through the very media sustaining their real relationship gives supple and transparent significance to the projected image of a couple literally interfacing with one another across the ether of the Internet.
Throughout Remote’s nonnarrative sequence of scenes, the social and psychological reification that treats human beings as physical objects (and even goats as “targets”) blends and contrasts with the primacy of human subjectivity, casting its own “projections” onto the physical world, whether in the name of emotional affinity or under the guise of scientific, clinical, or technological detachment. The theme gives rise to a number of inspired, gorgeous scenic compositions integrating Kraft and Purver’s video work, Frieda Kipar’s enveloping lighting design, Sheldon B. Smith’s haunting soundscapes, and Kraft’s melodic refrains (“The farther you are, the closer I feel to you. Stay away. Please stay away…”). The mise-en-scène shrewdly unites media and theme to make at once obvious and strange the Möbius strip carrying technological and mental projections of ourselves to the world and back again.
At the same time, there’s much laughter in Remote’s investigation of these fundamentally absurd situations. Even a little too much. (The recurring attempt by the psi warrior–in–training to explode the heart of the inert goat, for instance, comes perilously close to beating a dead horse.) But then, pinpointing the humor in the otherwise bleak and chilling territory of the postmodern is an integral and mostly successful part of Kraft and Purver’s revelatory mode. Remote lacks some of the consistency of their earlier work. Still, they have a proven knack for conveying the authentic human voice singing in those darkened woods and between those flickering screens. SFBG

Among proper names that suggest height or loftiness, few have a grander pedigree than Ararat, the moniker of the mountain or mountain range where, according to the book of Genesis, Noah’s ark was supposed to have made landfall after riding out the flood. Today’s Mount Ararat, a volcano rising nearly 17,000 feet above sea level, lies in northeastern Turkey, near that country’s borders with Iran and Armenia. Perhaps Noah and his menagerie washed up there, perhaps not; biblical scholars seem to love a good controversy, and various contrarian speculations bring the ark to ground on this or that mountaintop in Iran.
Whatever. While we wait for intrepid researchers to sort it all out with their satellite photos and expeditions and deconstructions of scripture, we can enjoy ourselves at Ararat, a Mediterranean tapas place opened by Koch Salgut in March at a Castro location not quite 17,000 feet above sea level but far enough above the street — 18th Street, if it matters, and for the people watchers among us it does — to provide a definite aerie experience. For a number of years the space housed North Beach expatriate la Mooné, and while that restaurant didn’t set any longevity records in the Castro, it did survive long enough in its comfy second-story digs to suggest that lack of a street-level presence isn’t necessarily fatal — not, at least, in a location with as much foot traffic as you find at 18th Street and Castro. Look for the sidewalk placard and the broad white staircase in need of a paint job and you are there, in a dining room the shape of a fat L with a groined ceiling and surveillance-friendly windows.
The chef, Caskun Bektas, has cooked in Istanbul, so there is a definite Turkish-metropolitan spin to the food. He turns out some dishes you aren’t likely to come across anywhere else, but even the more usual “Mediterranean” stuff confirms the sharp rise in Castro cooking standards in recent years. Despite the many distractions of the neighborhood’s street theater, people expect better food and know what to look for — and at Ararat, they are getting it.
Oddly, the one item on the menu we weren’t enthusiastic about is the first one listed and bears a distinctively Turkish name. It is ezme ($7), a mushy blend of barbecued eggplant, tomatoes, lemon juice, garlic, and roasted red bell peppers. We found it to be a little bitter, which is hardly an unfamiliar issue when dealing with eggplant.
But … the rest of the tapas (“mezes” is the authentic term) ranged from good to superb. (You can get a mixed platterful with warm pita triangles for $13; individually, they are all in the $5 to $7 range.) Falafel, tabbouleh, dolma, and hummus were all as expected, while the savory pastries — flutes of whole-wheat filo dough filled with feta cheese and herbs and crisped in oil — were like something from a Pepperidge Farm package and seemed to expand the field of possibilities for a cuisine that has come to occupy a spot in this country much like the one Mexican food held a generation ago. Restaurants serving the foods of the eastern Mediterranean have proliferated in recent years, and more and more people like the food and are comfortable ordering it, at least if they stay within the well-lit bounds of the familiar: dolma, shawarma, and falafel, nothing weird or unpronounceable, please.
Speaking of which: I have never had a preparation quite like Bektas’s signature dish, beyti kebab ($16). I have eaten and loved kebabs of various kinds, of course, and I like lavash (the Syrian flatbread), so I expected I would like “lavash rolls filled with delicate ground sirloin served with garlic flavored yogurt and marinara.” And I did. But I did not expect the beauty of the form. The lavash had been rolled around the meat like a wrapper — the meat wasn’t ground, incidentally, but it was surpassingly tender: filet mignon? — and then the package had been cut into thin coins that fanned out nicely on the plate. It was a little like a miniature beef Wellington, with yogurt instead of mushroom sauce.
The kitchen’s other savory showstopper is a shrimp casserole ($8), a crock of prawns swimming in a thick tomato sauce with bits of green bell pepper, caramelized onions, and mushrooms under a cap of melted mozzarella. This dish seemed more Provençal than Turkish, but it disappeared so fast it was hard to be sure. Running respectable races in the same heat were kakavia ($10), a stew of salmon, clams, mussels, shrimp, and scallops in a watery pepper-paprika broth, and kalamarika ($8), batter-fried calamari accompanied by batter-fried slices of lemon and potato, which were hard to tell apart without biting into them.
Also respectable, if not quite memorable, were a braised lamb shank ($18) served with couscous and an herbed tomato-Chianti sauce and mercimek kofte ($6), a hummus relative with red lentils substituted for chickpeas. Weaker — in fact disappointing — was the Ararat salad, a fey compilation of mixed greens, dried apricots, and walnuts, with a crotton of fried goat cheese on top. The promised balsamic vinaigrette was undetectable. Were we being set up for dessert?
If so, we must be grateful, for the dessert menu too includes a sublime dish: the nightingale’s nest ($5), a coil of baklava filled with lavender honey and finished with whipped cream and scatterings of crushed pistachios. Baklava so often flirts with being a cliché, like flan, but in imaginative and conscientious hands it can sing a lovely song, an ethereal melody from on high. SFBG

Plouf Mussels 10 ways — need we say more? Plouf knows its turf, and that’s surf. Maya is like a good French restaurant serving elegant food that tastes Mexican. A reporter in Wolf’s clothing

If freelance journalist Josh Wolf goes to jail for refusing to turn over what federal prosecutors say is video evidence of a crime that allegedly took place during a demonstration in July 2005, he’ll no doubt become a bigger cause célèbre in the lefty blogosphere.
But that doesn’t exactly make the prospect of jail time tantalizing. Wolf was hit with civil-contempt charges after refusing to testify before a federal grand jury and turn over video footage he’d obtained at a demonstration last summer in the Mission District against a G8 meeting in Scotland.
Some of the video has appeared publicly and Jeffrey Finigan, a prosecuting attorney involved in the case, saw it and wanted more. Prosecutors believe other portions of the tape, edited out by Wolf, contain evidence of protesters torching a cop car. Wolf denies that but says he’s standing on principle in withholding the tape. At the state level, Wolf is protected by California’s Shield Law, which is designed to protect the news-gathering process, but there is no federal equivalent.
Wolf attended a contempt hearing last week in federal court, where Judge William Alsup extended the issue to a future date, giving Finigan and Wolf’s East Bay attorney, José Luis Fuentes, time to iron out remaining questions about what protection Wolf might be afforded as a journalist. Wolf is also receiving help from the San Francisco office of the National Lawyers Guild and announced at a prehearing press conference that the Society of Professional Journalists recently gave $1,000 to his defense fund.
Wolf’s legal team has regularly lobbied the court to allow documents related to the case to be made publicly available, and several of them have been posted at Wolf’s Web site, Joshwolf.net. “We fought really hard to make all of those documents public,” Wolf said at the press conference. “It’s a situation where we have a lot of public information about it, which we’re lucky to have.”
Even if the contempt charges are tossed, Wolf could still decide to testify and turn over the tape with or without immunity from criminal charges that could be filed against him for any role he may have played in the alleged vandalism. At the press conference, Fuentes insisted the police department still has not stepped forward with any description of damages or subsequent costs reutf8g to the car.
The day of the press conference, Wolf’s story appeared on the blog Huffingtonpost.com via contributor Stephen Kaus. “The fact is that the effectiveness of the press is substantially diminished if every reporter is turned into a ‘surveillance camera’ as Wolf has claimed,” Kaus wrote. “Perhaps with exceptions for genuinely ‘terrible’ situations, the press cannot function if each crime-related story could turn into days of court testimony.” SFBG
