Leola King has lived your life, the lives of three friends and then some.

She’s traveled to Africa with the legendary entertainer, Josephine Baker. She’s featured jazz great Louis Armstrong at a popular Fillmore nightclub she helmed in the 1950s called the Blue Mirror, where she also once convinced a roomful of patrons to drink sweet champagne from the heel of her shoe.

She’s played host to the crusading television journalist Edward R. Murrow.

She’s even had a fling with championship boxer Joe Louis. From the ring at Madison Square Garden, he glanced toward her front-row seat, which she’d secured by chance during her first trip to New York, and had his lackeys retrieve her for a date afterward. Their rendezvous appeared as a gossip item in an Ohio paper and remains in its archives today.

Most of all, Leola King has come as close as anyone possibly can to experiencing bureaucratic hell on earth. For half a century, she’s been fighting with the San Francisco Redevelopment Agency, which has taken four pieces of her property, wiped out a restaurant and two nightclubs she owned, and left her with a string of broken promises.

Her story is evidence that the ugly local chapter of Western Addition redevelopment history still isn’t over – and it’s a demonstration of why so many African Americans in this town will never trust the Redevelopment Agency.

Beginning in the 1940s, King successfully operated a series of restaurants and nightclubs in the city, remarkable enough in an era that imposed a double-paned glass ceiling on black, female entrepreneurs.

“Back when I first moved onto Fillmore, it was very popular,” King told the Guardian. “Market Street didn’t have shit. They didn’t have traffic. They didn’t have nothing on Market Street.”

During the height of King’s accomplishments, the Redevelopment Agency infamously launched an ambitious project to clear out “blight” in the neighborhood. It was part of a nationwide urban-renewal trend, and while the project here still won’t be finished until 2009, it’s widely regarded as one of America’s worst urban-planning disasters.

In theory, Western Addition residents who were forced to give up their homes or businesses were given a “certificate of preference,” a promise that when the sometimes decaying buildings were turned to kindling and new ones built, the former occupants could return.

In practice, it didn’t work out that way. An estimated 5,500 certificates were issued to families and business owners shortly before the second phase of Western Addition redevelopment began in 1964. Some 5,000 families were dislodged and many of them fled to other sectors of the city (including Bayview-Hunter’s Point, which is today slated for its own redevelopment), or outside of the Bay Area completely.

Only a fraction of the certificates have benefited anyone. The agency has lost contact information for more than half of the holders, and redevelopment commissioners now openly admit the program is a joke.

“If we’re going to boast about being this diverse community in San Francisco, and we’re going to allow our African American population to become extinct, then how can we show our faces in government if we’re not really doing anything about it?” asked London Breed, a redevelopment commissioner appointed by Gavin Newsom in 2005. “And not just putting black people in low-income housing. There [are] a lot of middle-class African Americans all across America, specifically in the East Bay and in other places. Why do they choose to live in the East Bay over San Francisco?”

A renewed interest in the certificates by City Hall led to hearings this month, and District 5 Sup. Ross Mirkarimi has planned another for April.

King obtained two certificates, and attempts to later redeem them both devolved into costly legal wrangling with the agency that lasted more than two decades. She has never regained what she lost.

Leola King’s story is about more than certificates of preference. It’s a story about the troubling legacy of urban renewal.

King welcomes guests into her home on Eddy Street near Fillmore with ease. The living room in what is little more than a two-bedroom converted garage apartment swells unimaginably with antiques – three stuffed chairs with vinyl slips, crystal chandeliers, an ornate dining-room table, lamps, a fur throw.

She insists that she’s just 39 years old, but public records put her closer to 84.

When the Guardian first visited with her in person, she was dressed in black cotton leisure attire. Two chestnut braids cascaded from a gray Kangol-style cap, which she smoothed with her hands as they hugged a pair of light-skinned cherub cheeks.

King made her way west after spending her earliest years behind the barbed wire of a Cherokee reservation in Haskell, Ok. Her mother died when King was young, and her restless father had meandered off to Los Angeles. Her grandparents oversaw her adolescence before she trailed after her father to California, where he was establishing a chain of barbecue restaurants. She married a man at just 14, and a year later, she was a mother. Tony Tyler, her son, is a San Francisco tour guide today and remains a close confidant and business partner.

It was 1946 when she first landed in San Francisco and eventually started her own barbecue pit at 1601 Geary St., near Buchanan, historic building inspection records show. She called it Oklahoma King’s, and hungry San Franciscans were lured to the smell of exotic buffalo, deer and quail meats.

“That end of Fillmore was very popular all the way down until you got almost to Pacific [Avenue],” she said. “Heavily populated. There was at one time in that area of Fillmore over 100 bars alone. Lots of hamburger places. That’s where I had the barbecue pit.”

By 1949, however, Congress had made urban renewal federal law with the goal of leveling slums and deleting general “blight,” still the most popular and awkwardly defined threshold for determining where the government can clear homes and businesses using eminent domain.

The first redevelopment zone in the Western Addition, known as A-1, included Oklahoma King’s. She was paid approximately $25,000 for the property, but offered no relocation assistance or other compensation for the revenue she lost as a result of ceasing her day-to-day business.

Forging ahead, she opened in 1953 what became a hub of jazz and blues entertainment in the Fillmore, the Blue Mirror, at 935 Fillmore Street. The place was decorated with brass Greek figurines on the walls, a circular bar and velvet festoons. King spent a year hopping onto buses full of tourists and begging the driver to drop them by her nightclub for a drink. Before long, her brassy personality had attracted world-class performers, each of them adding electricity to the club’s reputation.

“She was the type of woman who knew how to handle people,” a Blue Mirror regular later said in the 2006 collection of Fillmore jazz-era photography, Harlem of the West. “She could talk to the pimps and hustlers. She didn’t play around, and they knew how to conduct themselves in her club.”

A musician who formerly worked there told the Guardian the Blue Mirror was one of the few places on Fillmore that actually provided live entertainment at that time. Bobbie Webb backed up B.B. King, Little Willie John, T-Bone Walker and others as a young saxophonist at the Blue Mirror with his band the Rhythm Rockers. He said the other establishments nearby on Fillmore were mostly bars except for headlining auditoriums where mainstream acts like James Brown and the Temptations performed. Smaller venues abounded up the street on Divisadero, he said, save mostly for King’s Blue Mirror and the Booker T. Washington Hotel.

“[King] didn’t only have a personality” said Webb, who now airs a show Tuesdays on 89.5 KPOO, “she was a beautiful lady. Personality just spoke for itself. All she had to do was stand there.”

But like virtually everyone in the neighborhood at that time, King rented the place where the Blue Mirror operated. Redevelopment again reached her business in the early 1960s. State booze enforcers, she says, claimed to have witnessed a bartender serving alcohol to a minor and her liquor license was taken away. When the Redevelopment Agency showed up shortly thereafter to sweep the block away, she was ejected without compensation because she wasn’t at that time technically in business.

Two more commercial and residential properties she owned on Post and Webster streets respectively were also eventually taken under redevelopment.

She pressed on, encouraged by Jewish business owners in the area she’d befriended, including liquor wholesaler Max Sobel and Fairmont Hotel operator Benjamin Swig.

“Whenever I’d lose something, they’d say, ‘Keep on moving. Don’t stop, because you’ll lose your customers. When you open back up, they won’t know who you are.’ They’re the ones who told me, ‘Go get another spot.'”

By the time King began work on her third business in the Fillmore, urban renewal projects had wreaked havoc on minority communities across the nation, including neighborhoods in west-side Boston, downtown Atlanta, the celebrated 18th & Vine District of Kansas City and elsewhere.

King opened the Bird Cage Tavern at 1505 Fillmore St. in 1964 near O’Farrell complete with a jukebox, 30-foot mahogany bar, a piano and a gilded birdcage. Then-police chief Thomas J. Cahill tried to block her liquor-license renewal by complaining to the state about “winos” and “prostitutes” in the neighborhood, records show, but regulators dismissed the claims.

“We had viable businesses all around us,” King said. “I had one fellow I worked with a lot named Willie Jones. He was a blues singer. The interesting thing was, I had music in the daytime at the Bird Cage. I specialized in afternoon jazz.”

Despite a triumphant resettlement, nonetheless, the redevelopment agency arrived yet again and bought her building during the expansion of it’s A-2 redevelopment phase and served as landlord for the Bird Cage, a barber shop and a liquor store as it waited for another two years deciding what to do with the building.

On the agency’s watch, a fire broke out next door to the Bird Cage that led to water damage in her space. Federal Housing and Urban Development records show that no insurance claim was ever filed by the Redevelopment Agency. King says the agency removed some of the bar’s contents, mostly kitchen supplies, and made only stopgap repairs to the building anticipating that she would later be ousted anyway. The items they took, she says, were never returned.

The agency then evicted all of the building’s tenants in 1974. This time, King stood fast and had to be forced out by the sheriff. The agency promised relocation assistance, but those empty assurances became her biggest headache yet. In fact, she would spend the next 25 years quarreling with the agency over relocation terms.

King and the agency searched fruitlessly until 1977 for a suitable replacement building before King purchased her own out of desperation at 1081 Post St. She was then forced to begin another endurance test of working to actually extract money from the agency owed to her for properly outfitting the new building.

Meanwhile, the Bird Cage’s leftover furnishings – from oil paintings, rugs and curtains to an ice maker, wood shelving and an antique porcelain lamp – were destroyed when the agency amazingly chose to store them on an outdoor lot off Third Street during her move, a fact later confirmed by an agency employee in an affidavit.

“They moved it all out,” King said, “all these antiques and stuff, into this field where the weather ate it up.”

The agency’s initial response was to determine how it could best avoid legal liability. Redevelopment officials finally offered her about $100,000, which she needed desperately to keep things moving with the Bird Cage’s new location, but King insists today the materials were worth closer to $1 million.

As she was fighting to reopen her bar business, she attempted to redeem an earlier certificate of preference given to her when she’d lost a residential property on Webster Street to redevelopment. In 1983, she bought a condemned, 12-unit apartment building on Eddy Street hoping to rehabilitate it using a federally backed loan.

The deal only led to more trouble. The agency paid for its own roving security to patrol Western Addition properties it had purchased, and before 1431 Eddy St. was ever officially conveyed to King (as well as two other neighboring developers), thieves gutted the building of windows, doors, plumbing, light fixtures and other hardware. (Two buildings belonging to neighboring developers were also hit, and the agency addressed their losses the same way.)

Almost immediately, the agency told her she’d purchased the building “as is” and that they weren’t responsible for the break-in. But according to an internal 1983 memo marked “confidential,” later unearthed when friends of King submitted a records request to the agency, staffers clearly were concerned about the legal implications of offering one building for sale “as is” and actually providing another one on the date of delivery that had been thoroughly burglarized.

The memo shows that the possibility of a lawsuit was of greater concern to the agency than any obligation to compensate King for the lost hardware, regardless of whether proper security was the agency’s responsibility. Records show they did discuss a settlement of little more than $2,000, but King considered the stolen goods to be worth thousands of dollars more.

She managed to eventually finish the rehabilitation of her Eddy Street property after several years of work, and while she lives there today, time and angst took their toll. Each step of the transition to what she hoped would someday become her new bar, Goldie’s on Post Street, involved a seemingly endless round of yet more negotiations, letters, legal threats and bureaucratic backbiting before the agency would lift a finger and allocate money for contractors, necessary seismic upgrades, architects and equipment.

In 1997, then-Rep. Ron Dellums (now Oakland mayor) wrote a letter to top local HUD official Art Agnos (later a San Francisco mayor) on King’s behalf.

“On August 26, Ms. King met with a member of my staff and detailed issues surrounding a 25-year dispute she has attempted to resolve with HUD and the San Francisco Redevelopment Agency,” Dellums wrote. “Your expeditious attention to this matter is [a] request, as Ms. King is elderly and experiencing health problems. The resolution to this issue would allow her to live the remainder of her life with some piece of mind.”

It was too late. The federally backed loans she’d received from HUD to rehab her Eddy Street property, from which the Redevelopment Agency strictly enforced repayment, fell into default. Loans leveraged against her other remaining properties began to slip, too, all while she fought with the forces of redevelopment to recreate what she had once proudly possessed.

King’s story may seem like an unfathomable streak of bad luck, but there’s a paper trail for all of it. And her battle, laid out in hundreds of pages of documents saved by King over several decades and reviewed by the Guardian, was ultimately unsuccessful..

By 1997, King was submerged in bankruptcy proceedings and would lose pretty much everything that she owned, including an Edwardian landmark home on Scott Street near Alamo Square where she’d lived for years (partially burned in a 1986 fire, believe it or not) and a residential building on Sutter Street.

Goldie’s was to be her final resting place, a roost from which she hoped to feature cabaret dancing, fresh crab at happy hour, a refined art deco aesthetic and live music performances. She lost that, too. Today, it’s Diva’s just off Polk Street.

Urban renewal won.

Hopeful press accounts lately foretell a jazz revival in the Fillmore District fueled by enterprising developers deft at financing lucrative redevelopment projects through tax incentives and low-interest loans half a century after the promise of “renewal,” now described euphemistically as “historic preservation.”

But with such a sordid history behind them, it’s no wonder residents of Bayview-Hunter’s Point, many of whom escaped Western Addition “renewal” in the first place, are leery of a pending years-long plan to redevelop nearly 1,500 acres in the southeast neighborhoods.

Bayview newspaper publisher Willie Ratcliff led a petition drive last year in an effort to put the plan before voters. Over 20,000 petition signatures were certified by elections officials, but City Attorney Dennis Herrera ruled the petitions were technically invalid because circulators hadn’t presented the full text of the redevelopment plan to signers. Redevelopment foes have since sued to have Herrera’s decision tossed.

“The misuse by these people is just unbelievable,” King said. “They were fighting me every inch.”

The giant extension-cord plan

EDITORIAL It’s only because of a dark moment in San Francisco’s history that city officials are trying to figure out what to do about an underwater electricity cable that’s slated to run from Pittsburg onto port property and provide additional power for the tip of the Peninsula.

San Francisco was supposed to have its own power cable, carrying its own power over the bay from the hydroelectric dam at Hetch Hetchy. In fact, in the 1920s the city built 99 miles of cable, from the high Sierra to the South Bay … and mysteriously ran out of copper wire a few yards from a new Pacific Gas and Electric Co. substation in Newark.

That was a key moment in the Raker Act scandal, the ongoing violation of federal law that has allowed PG&E to operate a monopoly private power agency in a city that’s supposed to have public power.

But now PG&E controls all the power coming into town — and the California Independent System Operator, which is responsible for the state grid, says the supply coming into San Francisco is too limited and not sufficiently reliable.

As JB Powell reports in "Power Play" on page TK, Babcock and Brown, an international financial firm based in Australia, has put up $300 million for a Trans Bay Cable that would link the city to the East Bay. Ironically, a public power agency — in Pittsburg — would wind up making money off the project by selling power in San Francisco. Other than rent at the port, this city will get nothing out of the deal.

There are some basic conceptual problems with the project. Most of the power shipped along the 57-mile, 400-megawatt line would be produced by fossil fuel plants. That’s contrary to the direction the city is trying to go: San Francisco is in the process of building solar projects and is looking into using tidal energy. The Hetch Hetchy project, of course, is hydropower. And critics say that the new line would flood San Francisco with an oversupply of electricity, discouraging the environmentally sound approach of conservation.

But there’s a larger problem here: a private venture firm will own the cable — and could sell it to another entity, perhaps PG&E. So the city’s energy future under this scenario will still be tied to unaccountable private interests.

Sup. Ross Mirkarimi, whose Local Agency Formation Commission held a hearing on the cable plan in January, asked San Francisco Public Utilities Commission (SFPUC) staffers why the city doesn’t have its own line. The agency, staffer Barbara Hale said, has been looking into that — but any project would be years away.

Still, this line, if the city goes along with the deal, will be with us for decades — and the Board of Supervisors shouldn’t just approve it without looking at its role in a long-term municipal energy program. San Francisco is moving inexorably toward public power — too slowly, but inexorably. How, exactly, does this cable fit into a municipal power system? Does San Francisco even need it? Is a publicly owned transbay power line something that ought to be on the agenda? Why would the city want to go along with this private venture if there is (or ought to be) a city project in the wings?

Nobody has answered those questions, because the city still lacks a detailed public power plan. Before the supervisors approve this cable, the SFPUC needs to look at all the energy options, prepare a long-term plan, and evaluate whether this giant extension cord fits into it. *

The San Francisco Board of Supervisors will soon decide the fate of the Trans Bay Cable (TBC), a privately financed, underwater power line that would plug the city’s electric grid into power plants in the East Bay.

Backers call the cable the best way to avoid blackouts, like those the city saw in the wake of the energy deregulation debacle of the late 1990s. But green power activists argue that the developer of this 57-mile extension cord is cashing in on California’s blackout fears and that approving the project would go against the city’s commitment to finding sustainable sources of energy.

Australian financial firm Babcock and Brown has staked $300 million on the cable’s construction and offered more than $28 million for a community benefits package if the project is approved. The developer plans to profit on its investment with a guaranteed 13.5 percent rate of return, granted to it by the Federal Energy Regulatory Commission for the sale of power running through the cable. Power plants in and around Pittsburg would generate most of the juice going though the 400-megawatt-capacity line. Ratepayers across the state would foot the bill.

The California Independent System Operator (Cal-ISO), the public benefit corporation in charge of the state’s electric grid, has asked for San Francisco supervisors to approve the cable as soon as possible so that it can begin service by 2010. Cal-ISO’s sole mission is to keep the lights on, and when there isn’t enough power in the system, it coordinates the dreaded rolling blackouts that most Californians remember from the energy crisis. CAL-ISO representative Larry Tobias brought up those dark days at a San Francisco Port Commission meeting Feb. 27. "Without the Trans Bay Cable project," he warned, "we will be back in that situation again." Electricity from the TBC, Tobias told commissioners, will give the city’s system the "reliability" to prevent blackouts.

Tobias said if supervisors reject the cable project, CAL-ISO will have to seek alternative proposals. At a January meeting of the city’s Local Agency Formation Committee (LAFCo), Tobias brought up a plan previously put forward by Pacific Gas and Electric Co., which looked to bring power across the bay from a substation in Moraga. In 2005, PG&E asked for more time to finish its design. CAL-ISO rejected its request and chose the TBC instead.

But some local activists say the city does not need the cable, or any other privately funded power line. Steven J. Moss of San Francisco Community Power told the Guardian a 400-megawatt cable would flood the power grid with "an enormous oversupply" of electricity. "That would be a waste of resources," he said. Moss claims CAL-ISO is understandably obsessed with reliability but the probability of its doomsday blackout scenarios is incredibly small. How small? At the Port Commission’s March 13 meeting, Moss said his calculations indicate there is only a "0.0002 percent chance that the [TBC] will be needed."

Even in the worst-case scenario, Moss told us, the city is only "looking at a 50- to 60-megawatt gap [in energy supplies] 10 years from now." His figures, he said, are based on Cal-ISO’s own estimates, adding, "The real way to plug that gap [is] demand management — solar, wind, all the things that San Francisco talks about constantly and that are good for us."

At the January LAFCo hearing, Sup. Ross Mirkarimi questioned officials from the San Francisco Public Utilities Commission (SFPUC) about the city’s plans to acquire its own power line from the Hetch Hetchy Reservoir’s hydroelectric stations. The city already owns most of the 200-mile transmission route from the Yosemite power stations, but PG&E possesses the last 30 miles and charges the city fees to bring electricity up the Peninsula from Newark. "Why can’t we have our own cable?" Mirkarimi asked SFPUC staffer Barbara Hale. She said the agency has been "studying the feasibility" of the proposed city-owned line but cannot yet commit to a firm "coming online date" like the TBC’s developer can.

For years the city has been seeking a way to secure full ownership of the Hetch Hetchy lines as a step toward forming a public power utility, independent of PG&E control. Ironically, if the TBC is built, a public power agency would own the cable and profit from it, just not San Francisco’s power agency. Pittsburg’s municipal utility is slated to take over the line once Babcock and Brown finishes its construction.

At the same hearing in January, Moss pointed to such projects as the proposed Hetch Hetchy line, as well as the city’s evolving plans to implement more renewable power sources, as proof that supervisors should reject the TBC. Calling the cable a "potlatch," Moss said, "Time is our friend" in power matters. "Technology will change and improve, [and] we’re potentially rushing into a very expensive project." Mirkarimi did not return calls for comment, but at the hearing, he indicated he is still studying the cable and has not yet formed a position on it.

Philip DeAndrade, chair of the city’s Power Plant Task Force, expressed concerns that Pittsburg’s power plants burn "very available fossil fuels" for their generation and that these cheaper sources of electricity "might take out of the market mix" more renewable energy. DeAndrade also brought up the four gas-fired combustion turbines, known as peakers, that the city is in the process of bringing online. With these generators scheduled to go into service in 2009, as well as several PG&E transmission projects either in the works or already operational, DeAndrade said, "I’m not convinced [the TBC] is a good deal for San Francisco. What it looks like is a good deal for Babcock and Brown and the City of Pittsburg."

CAL-ISO insists that the TBC is the best reliability option for the region. Spokesperson Gregg Fishman said the peakers and other local energy projects will allow the system operator to stop relying on the inefficient Potrero Hill Power Plant. "But all that really does is keep us even in San Francisco. It doesn’t improve the reliability of the system at all — and in fact, with load [demand] growth we are actually falling slowly behind." Fishman later mentioned the added benefits of having power come in from a different direction. Currently, all power lines feeding the city travel up the Peninsula.

On March 13 the TBC cleared its first local regulatory hurdle when the Port Commission approved a licensing agreement for the cable’s facilities. Port officials, along with staff from the Mayor’s Office and other city agencies, spent weeks negotiating the terms of the deal with Babcock and Brown. The agreement grants the port annual rent payments in excess of $1 million, a needed cash infusion for the strapped agency.

The community benefits package gives the port an additional $5.5 million, with an as yet undetermined portion of those funds to be spent on open-space and energy-related projects on port-owned land. In addition to payments to the port, Babcock and Brown pledged more than $23 million to the SFPUC for sustainable energy programs, such as solar, wind, and tidal power initiatives.

Despite passing the licensing and benefits packages, port commissioners and their staff said they were not ruling on the project’s merits in terms of energy policy. Port special projects manager Brad Benson, who spearheaded the negotiations, told us, "Port staff does not believe we have the required expertise to rule on energy policy aspects [of the TBC]. We believe the Board of Supervisors is the preferred venue" to settle those questions.

Reached for comment, several San Francisco supervisors, either directly or through staff, told us they are still making up their minds about the project. Sup. Sophie Maxwell told us even if the cable is built, the city will not allow the new power line to sidetrack its efforts to use more environmentally friendly energy. "The city’s policy is renewable energy. Fossil fuel is not our first and primary desire." But, she added, Cal-ISO "determine[s] our power needs, and so we have to go along with that. We can’t say, ‘No … you’re wrong.’ "

Babcock and Brown vice president Dave Parquet praised the Port Commission for approving the licensing agreement and benefits package, telling us, "We are very pleased with the port’s [approval] and look forward to the Board of Supervisors’ decision." Samuel Wehn, the TBC’s project manager at Babcock and Brown, said, "I don’t think San Francisco [officials are] going to put their city in the position where they’re not going to be able to provide the kind of energy that’s needed to keep this city running."

Moss said those kinds of arguments are "business as usual" for the state in terms of energy policy. "Here [we] go again with another large infrastructure project that doesn’t contribute to solving climate change or moving our energy agenda forward."

He added, "It’s classic political science. Out of [the average ratepayer’s bill] it’s pennies per month, so nobody cares about it … but that doesn’t mean it’s not an expensive project. It is." Babcock and Brown, he said, "saw an opportunity to make a very fat profit margin, and they went for it like any good profiteer." *

Cofounder of the 34-year-old Castro Street Fair, the 30-year-old Haight Ashbury Street Fair, and the three-year-old Asian Heritage Street Celebration, Heising has a legacy that goes beyond mural preservation, and his unexpected death Dec. 20, 2006, was widely mourned. Join his surviving family and friends, Supervisors Ross Mirkarimi and Tom Ammiano, and performers in re-creating an indoor minifair to celebrate the man. (Nicole Gluckstern)

I made it through the week without anyone calling to complain about my analysis of the mayor’s race, so maybe for once I got it right: unless Gavin Newsom drops out or a third strike drops and it’s pretty bad, we already know what things are going to look like in the fall.

So we might as well get on with it: Matt Gonzalez and Ross Mirkarimi should get together and talk it out, then one of them should just go ahead and announce.

For a long list of reasons, there has to be a real mayor’s race this fall — and Tony Hall plus a few nutcases against Mayor Newsom doesn’t count. The progressives need someone to rally around, to get the old troops out and in the streets and some new ones trained and energized. We need to keep Newsom on the defensive, to keep our issues out there, to hold him accountable not just to his donors but to the rest of the city.

Never discount what a good challenge can do: there are a lot of reasons why Sup. Bevan Dufty has moved a few steps to the left over the past few months, but one of them is absolutely the fact that he had a progressive candidate running against him in the fall.

Besides, I actually think Newsom can be defeated.

Just look at his record. Since he hasn’t accomplished much of anything, he’s vulnerable on almost everything. Other than same-sex marriage, his major legacy at this point seems to be trying to hand out the city’s information technology infrastructure to Google and EarthLink. Go team.

And the city’s two leading Greens both have a distinct advantage at this point — nobody is going to accuse them of jumping into the race to take advantage of Newsom’s personal problems. Long before city hall got all steamed up, Mirkarimi and Gonzalez were talking about running — on the issues.

Gonzalez can raise a lot of money. Mirkarimi has done something few progressives ever pull off: turning public safety into one of our top issues. Like almost all candidates, they both have strengths and weaknesses, but in the end, it looks like one of them is going to be our contender this fall, and that’s not at all a bad thing.

We went after District Attorney Kamala Harris a couple weeks ago when she tried to make some changes in the pretrial diversion program that would have cut back on its effectiveness. Harris did the right thing; she and Public Defender Jeff Adachi reached an agreement that preserved the best of the program, which tries to steer first-time misdemeanor offenders into counseling and out of the criminal justice system.

Harris didn’t have to do that; the program is entirely under her control, and she could have told Adachi (and us) to take a hike and done it her way. But she showed that she’s a reasonable DA who is willing to listen.

Now, however, the thugs at the Police Officers Association are attacking her for her willingness to include misdemeanor noninjury assaults on cops as crimes that are eligible for diversion. (This is typically stuff like someone spitting at an officer or brushing against him or her during an arrest. We’re not talking about serious assaults here.)

Harris is standing up to the POA, but the rest of the city, including the mayor, needs to get behind her. *

If the Matier and Ross report in the San Francisco Chronicle on Feb. 11 is to believed, then Mayor Gavin Newsom is actually taking his alcohol problem seriously. Mimi Silbert, who runs Delancey Street, told the dynamic duo that Newsom has been showing up every night for three or four hours of intense counseling and therapy. Good for him. If his problem is bad enough that he needs that much help, he’d probably be better off taking some time away from work, but I’m not him, and at least he’s trying.

Or so they say.

Of course, if the whole "treatment" thing is just an attempt to gain sympathy from the public and take the story away from his sordid affair, I suspect Newsom’s visits to Delancey Street will start to taper off fast — in which case a lot of people who have friends and family who truly have struggled with alcoholism will be properly pissed at his honor the mayor.

It’s going to sound like a cliché at this point, but I kinda think it’s true enough to make it our mantra for the fall: Newsom has been doing a rotten job of late, and if his personal problems are to blame for that, then he needs to get the hell out of politics until he’s a lot stabler, and if his personal problems aren’t to blame, then he’s just a weak and lame mayor. Either way, four more years doesn’t work.

Which brings us to the real question that was on everyone’s mind at the Guardian‘s 40th anniversary party last week: who?

Let me throw out some thoughts.

I’ll start with the wild card. There isn’t one. I see nobody hiding in the bushes who can run as a progressive and mount a serious campaign. We’ve got what we see. (Don’t talk to me about Art Agnos; the guy would have to enter a political 12-step, make a lot of amends, and admit all the things he did wrong as mayor last time around, and it ain’t happening.)

So here’s Scenario One: Newsom toughs it out, nothing else awful drops, and he stays in the race. Honestly, very few people are going to challenge him. Not Mark Leno, not Carole Migden, not Dennis Herrera, not Aaron Peskin. They don’t want to look like they’re exploiting Newsom’s personal problems, so they all wait four years.

So the left candidate is Ross Mirkarimi or Matt Gonzalez. If Gonzalez wants it, Mirkarimi steps out of the way. That could set up Matt vs. Gavin, round two, with Gonzalez as the candidate of the left and the Residential Builders Association, leaving people like me (who think land use is supremely important) tearing our hair out. And let’s remember that Jack Davis, the political mastermind, is going to be a player this time, and it won’t be with a loser like Tony Hall.

Scenario Two: Newsom decides, for whatever reason, to withdraw — and it’s a free-for-all. Gonzalez is suddenly not the leading candidate; that’s probably Leno, Herrera, or, on the outside, Kamala Harris. Which leaves the progressives with a sticky choice: stay with Gonzalez or accept someone who on paper (and on the record) is more centrist but will promise a whole lot to get our support and could be the odds-on favorite.

Throw in public financing and ranked-choice voting, and the election’s going to be like nothing there ever was in this town. I can’t wait. *

Outcry as Caged Wolf enters Guiness Book of Records

“I thought this was going to be about Newsom resigning,” said a bicyclist, who’d screeched to a halt to see what yesterday’s noon-time commotion at City Hall was about.
No such mayoral luck (for now) and definitely no sign of the disgraced Newsom as demonstrators gathered on the steps of City Hall to protest the continuing incarceration of freelance journalist Josh Wolf.
At 169 days inside, Wolf has made it into the Guiness Book of Records as the longest-imprisoned journalist in U.S. History. It’s a record that anyone who’s serious about gathering, spreading and accessing information in this age of faux news and spin control can’t help admiring and respecting the 24-year-old Wolf for setting, because handing over your notes, photos or video footage to the feds is not OK, at least not if you want your sources to take you seriously whenever you interview, tape, film them, or promise them confidentiality.
It’s a point Sup. Ross Mirkarimi evidently gets, as witnessed by the impassioned speech the Mirkster delivered at the Feb. 6 Free Josh Wolf rally. Incensed by US District Judge William Alsup, who’s holding Wolf in contempt for refusing to handover video outtakes of a July 2005 anarchist protest turned violent, and outraged by the US Attorney’s Office, who claims Wolf isn’t really a journalist, Mirkarimi encouraged the crowd to join in “loud solidarity against thuggery.”
“Judge Alsup is the ‘alleged’ judge. He should not be on the bench adjudicating,” declared Mirkarimi, flanked by Sup, Tom Ammiano and Jake McGoldrick.
As for the missing Mayor Newsom, Mirkarimi gave the Gavsta a piece of his mind, too, observing that when the Board of Supervisors passed a resolution in support of Wolf and the need for federal shield laws Newsom didn’t sign the resolution. (Hiss! Boo! Buck buck buck.)
Mirkarimi spoke in equally scathing manner of District Attorney Kamala Harris and House Speaker Nancy Pelosi, neither of whom advocated for Wolf in the wake of his incarceration last fall.
“At the very least, they should use their bully pulpit, even if they don’t have the legal reach,” Mirkarimi intoned. “ It does not speak well of the city with the progressive values to stand back in this case. This is not a fringe movement. I don’t care if Josh Wolf s a journalist, a freelancer or a blogger. He’s part of the wave of the future. I’m angry as hell about this. At 169 days inside, there should be a serious outcry.”

The format is always the same: Mayor Gavin Newsom shows up at a carefully scouted location somewhere in the city with his perfect tie and perfect hair. He brings a cadre of department heads in tow, sending the clear message that he can deliver government services to the public. He takes a few questions from the audience, but the format allows him to deflect anything tough, to delegate any problems to department heads, and to offer a thoughtful “we’ll look into that” when the need arises.

There is no substantive discussion of anything controversial — and no chance for anyone to see the mayor debate contentious issues.

This, of course, is by design.

Newsom has made it very clear during his first term as mayor that he can’t take the heat. He is the imperious press release mayor, smiling for the cameras, quick with his sound bites, and utterly unwilling to engage in any public discussion whose outcome isn’t established in advance.

He has become Mayor Chicken.

So don’t expect any leadership from Newsom during an upcoming series of what the Mayor’s Office is calling “policy town hall meetings” that have been hastily scheduled this year, beginning Jan. 13 in the Richmond District with a discussion of homelessness. The town hall meeting is just politics as usual for Newsom. Since taking office in 2004, he’s held eight of these stage-managed events.

“He does a good Phil Donahue shtick,” says Sup. Chris Daly, recalling one such town hall meeting Newsom held in Daly’s District 6 after he was elected mayor. “Scripted town hall meetings are smart politics for Newsom.”

Scripted events weren’t what Daly had in mind when he wrote Proposition I, which calls on the mayor to appear before the supervisors once a month to answer questions. And these campaign-style events certainly weren’t what voters had in mind Nov. 7, 2006, when 56.42 percent of them approved the Daly legislation, which asks the mayor in no uncertain terms to appear “in person at regularly scheduled meetings of the Board of Supervisors to engage in formal policy discussions with members of the Board.”

Examiner columnist Ken Garcia — a conservative hack who regularly sucks up to Newsom — recently dismissed the voter-approved measure as “a silly, obvious stunt to play rhetorical games with the mayor,” which is how the Newsom camp would like to spin things. But Daly recalls how when he first mentioned the idea of a mayoral question time — back when Willie Brown was still in Room 200 — he was sitting next to then-supervisor Newsom, “who thought it was a great idea.”

It’s hardly an unprecedented concept. Ken Livingstone, the mayor of London, meets with his city’s assembly 10 times a year and presents a detailed report on initiatives and progress. But now Newsom is mayor, suddenly Daly’s idea doesn’t strike him as all that great any more.

While it’s easy to accuse Daly of playing political games, it’s not so easy for Newsom — who loves to talk about the “will of the voters” — to dodge Prop. I. Newsom’s decision to snub voters and avoid real debate was so obvious that he got beat up on both the Chronicle and Examiner editorial pages, on several prominent local blogs, and in television broadcasts. Perhaps that’s why he decided this week to show up and give a speech at the Board of Supervisors inauguration Jan. 8, the first time in years he’s set foot in those chambers. He’s trying to look like he’s complying with voters’ wishes when he’s really doing nothing of the sort.

 

THE “KUMBAYA MOMENT”

It didn’t have to be this way. As board chair Aaron Peskin’s legislative aide David Noyola told the Guardian, immediately after Prop. I passed, Peskin tried to “depoliticize the issue” by becoming the sponsor of a motion to amend board rules.

Peskin’s motion aimed to make space on the board’s agenda for the mayor every third Tuesday so he could address the supervisors on policy matters — a matter he planned to discuss at the Dec. 7 meeting of the Rules Committee.

But two days earlier the mayor took his first jab at ducking the intent of Prop. I. He sent the supervisors a letter in which he claimed that to truly serve the public interest “we should hold these conversations in the community.”

Next, Newsom sent staffers to the Rules Committee hearing, where members discussed how not to force the implementation of Prop. I down the mayor’s throat — and the mayor’s staff claimed they’d be happy to work with the committee to that end.

As a result of this “kumbaya moment,” as Noyola calls it, the Rules Committee decided to continue the item to the following week to have more productive conversation. Meanwhile and unbeknownst to them, 19 minutes into the hearing, the Mayor’s Office of Communications issued a press release outlining Newsom’s intent to hold a town hall meeting in the Richmond District on Jan. 13 — which the mayor said would substitute for complying with Prop. I.

“The Rules Committee was blindsided by the mayor’s press release,” Noyola says.

The mayor, of course, said that all the supervisors were welcome to attend his town hall event and participate in the discussion, giving the appearance he was happy to debate but wanted to do so out in the neighborhoods. But that was a lie: Newsom and his staff knew very well that under state law, the supervisors were barred from participating in any such event.

According to the Brown Act, if a quorum of supervisors wants to be somewhere to discuss business that may be before the board in the future — such as homelessness — and if it wants policy interactions, the clerk must give notice that the supervisors intend to hold a special meeting.

The board actually discussed Newsom’s invitation, and board clerk Gloria Young estimated it would cost $10,000 to $15,000 to staff. It also raised serious procedural and legal questions for the board.

In other words, Newsom knew the supes couldn’t just show up and ask questions.

“But if the mayor wants people to just sit and attend a presentation in the background, like at a speech or a Christmas event, then special meeting notice isn’t needed,” notes Noyola, explaining why Peskin ultimately dismissed the mayor’s invite as “childish” — and why Peskin now says he’d support making question time a charter amendment, thereby forcing the mayor to comply with the will of the voters.

 

WHO’S PLAYING GAMES?

While the Newsom camp continues to dismiss the Daly-authored Prop. I as “political theater,” the supervisor is quick to counter it’s the Mayor’s Office that’s playing games.

“They claim political theater, but if that’s what it takes to get serious policy discussions going, then so be it,” says Daly, noting he has had one private discussion with the mayor in two years, while Sup. Geraldo Sandoval has not talked to him at all. “Newsom claims he has an open door to his office, but so do I — and he’s never been to mine. For the mayor to refuse to discuss important policy items and hide behind ‘I’m afraid of Chris Daly’ is pathetic. Willie Brown probably would have come.”

Daly also observes that San Francisco’s government is structurally unique within California because it represents a city and a county.

“It’s an awkward setup in which there is little formal communication between the board and the mayor,” Daly says, “other than when the board forwards legislation to the mayor for him to approve or veto.”

It’s a structural weakness that hasn’t been helped by the fact that in the three years since he was elected, Newsom only appeared before the board twice — this week and for the board inauguration two years ago — both times giving a brief speech but not engaging in dialogue. It’s an anomaly without precedent in the history of San Francisco. (It’s customary for mayors to deliver their State of the City speeches in the board chambers, but Newsom has done all his at venues outside City Hall.) Most mayors also make a point of occasionally appearing at board meetings (Willie Brown would sometimes even take questions from the supervisors).

On Jan. 8, Newsom slipped in at the last minute and sat next to Peskin until it was his turn to make some brief remarks, an opportunity that immediately followed public comment, during which a baseball-capped woman pleaded with the supervisors to “please kiss and make up with mayor.”

After Peskin welcomed “the 42nd mayor, Gavin Christopher Newsom, to these chambers where you are always welcome,” Newsom rose — and was hissed by a few members of the audience.

“This is a city that’s highly critical of its leadership and that expects greatness from its leaders,” the mayor said. “I have great expectations of 2007…. The key is to work together on the things that unite us…. I look forward to engaging with each and every one of you.”

 

WORKING TOGETHER

This isn’t just politics — there are serious issues involved. Without the monthly question time the Board of Supervisors requested and the voters approved, it’s hard for the city’s elected district representatives to figure out if this mayor actually supports or even understands the issues he claims to champion.

Last year, for example, Newsom was happy to take credit in the national press for the universal health care package that actually came from Sup. Tom Ammiano. But when Ammiano got blasted by business leaders, Newsom didn’t rush to defend the plan; it was hard to tell if he even still supported it.

Business leaders didn’t like that the proposal required employers to provide health care insurance. But Newsom’s own staff recognized that without that mandate, the plan would never work. Did the mayor support it or not?

The situation prompted Sup. Ross Mirkarimi to characterize the mayor’s proposal as “a one-winged aircraft that doesn’t fly,” and it was left to Newsom’s public health director, Dr. Mitch Katz, to confirm that both the voluntary and mandatory pieces of the legislation are joined at the hip. “One can’t successfully move forward without the other,” Katz said at a July 11 board meeting, which Newsom, of course, did not attend.

Since then, the mayor’s commitment to the amalgamated health care package has been thrown into question once again, this time thanks to a lawsuit the Golden Gate Restaurant Association filed only against the employer mandate aspect of the legislation.

The GGRA, which filed its suit the day after the election, is a Newsom ally that funneled more than a half million dollars in soft money into Rob Black’s unsuccessful campaign against District 6’s Daly and into Doug Chan’s coffers for his disastrous fourth-place showing in District 4.

Asked if he knows where the mayor stands on the city’s universal health care plan, Ammiano told the Guardian, “We’ll be meeting with Newsom in the new year and asking for a press conference in which we both pledge to give our continued support for all aspects of plan, but that’s not yet been nailed down.”

Ammiano’s experience is one example of repeated communication breakdowns between Newsom and the board, which have severely hindered policy discussions and the cause of “good government” to which Newsom so frequently pledges his fealty. As a result, Newsom has often ended up vetoing legislation only to reveal in his veto letter that all the legislation needed was a few minor tweaks — changes he might have just asked for had he been more engaged.

Consider how a year ago, Newsom vetoed legislation designed to limit how much parking could be included along with the 10,000 units of housing that were to be built in downtown San Francisco. The legislation was proposed by Newsom’s planning director, Dean Macris, and supported by every member of the Planning Commission but one.

When Newsom caught heat from downtown developers over the measure (see “Joining the Battle,” 2/8/06), he sent surrogates to muddy the waters and make his position unclear until after it was approved by the board. Newsom vetoed the measure, then proposed a couple prodeveloper amendments that hadn’t been brought to the board discussions.

“I’m trying to get the political leaders to come to an agreement because the city needs this,” a frustrated Macris told the Guardian at the time.

A few months later the board was similarly blindsided when it tried to approve legislation that would have created a six-month trial closure on Saturdays of some roads in Golden Gate Park. Newsom’s board liaison, Wade Crowfoot, worked closely with bicycle advocates and sponsor Sup. Jake McGoldrick to modify the legislation into something the mayor might be able to support.

Everyone involved thought they had a deal. Then, for reasons that still aren’t entirely clear, Newsom vetoed the measure. One of the reasons he cited was the fact that voters had rejected Saturday closure back in the 1990s, before the construction of an underground parking garage that still never fills up.

“For what it’s worth, what really sells it for me on this issue of the will of the voters was the shit I went through after Care Not Cash, when the voters supported it and [my critics] did everything to put up roadblocks. And I was making a lot of these same arguments, you know, so this hits close to home,” Newsom told the Guardian a few days after he vetoed Healthy Saturdays.

His words seem ironic: he loves the will of the voters when it suits his interest but not when it requires him to act like a real mayor.

This isn’t the first time Newsom’s been selective in honoring what the voters want: he also refused to hold up the Candlestick Park naming deal with Monster Cable, even though voters rejected it through Proposition H in 2004.

Last October, Newsom’s veto of Mirkarimi’s wildly popular foot patrol legislation led to a humiliating 9–2 override in November, but not before he’d dragged San Francisco Police Department chief Heather Fong with him through the political mud and created an unpleasant rift between himself and his formerly loyal ally Sup. Bevan Dufty.

Newsom has tried to spin his refusal to engage in question time as something other than defiance of voters by proposing the upcoming series of town hall meetings.

“Bringing these conversations to the neighborhoods — during nonwork hours — will allow residents to participate and will ensure transparent dialogue, while avoiding the politicized, counterproductive arguing that too often takes place in the confines of City Hall,” Newsom wrote in his Dec. 5 letter.

But even the Chronicle and the Examiner — neither of which have been supportive of progressives in City Hall — have condemned Newsom for ducking this fight. On Dec. 18, Chronicle editorial writer Marshall Kirduff opined, “There is no end of topics to discuss — a Muni overhaul, a new neighborhood coming to Treasure Island, police policies, the ever-with-us homeless. The city could do with more debate even at considerable risk of dopey rhetoric. That means the mayor should step out of his office, walk across City Hall and face the supervisors. It’s time to bring on the questions.”

Meanwhile, Daly notes the mayor has been spending excessive time out of state, not to mention making frequent trips to Southern California. “I think we should subpoena the guy; he doesn’t know what’s going on,” Daly quips.

A classic example of Newsom’s cluelessness about the local political scene occurred live on TV shortly after 59 percent of San Francisco voted to impeach President George W. Bush and Vice President Dick Cheney. Asked during a Nov. 16 City Desk News Hour interview with Barbara Taylor about Proposition J’s passage, Newsom said, “I am told Congress is going to come to a halt next week, and they’re going to reflect on this new San Francisco value. Before you impeach the president, you should consider the guy who would become president. Why don’t you start with the top two?”

Yup, it’s definitely time to bring on those questions. *

Mining metadata

The Board of Supervisors’ Rules Committee unanimously recommended Nov. 30 that all parts of a city document should remain in the public domain, including the document’s electronic fabric, or metadata.
If approved by the full board, which seems likely, the decision will signal a victory for a small but vocal group of activists who view metadata as an important front in the battle for public access to government documents.
Metadata is defined as data about data — information that can reveal nuances of a document, such as where it was created, how it was modified, and when it was transmitted. If you know how to use the Track Changes function in Microsoft Word, for instance, you can glean how a document’s numbers were calculated or how its text evolved.
Local activists Allen Grossman and Kimo Crossman argue that such access to city documents is one of our privileges as citizens: we pay for city government to represent us with our tax dollars and therefore have the right to track almost everything it does — down to the faintest of electronic fingerprints on an Excel spreadsheet. Grossman and Crossman got involved with the fight for metadata when board clerk Gloria Young denied their request for a copy of the Sunshine Ordinance in its original Microsoft Word format.
“Are we gadflies, whatever that means?” Grossman asked the Guardian the day before the Rules Committee made its recommendation. “I don’t think so. I think we have an interest in making sure that everyone else knows what’s going on.”
Some city officials say that granting boundless access to documents and their metadata is risky. Deputy city attorney Paul Zarefsky wrote a five-page memo expounding the dangers: it could let hackers into the computer system; it could leave city documents open to manipulation; it could burden city officials with more data awaiting redaction.
He and Young proposed that all city documents should be presented to the general public as PDFs, or portable document formats, which would exclude any metadata from the original document.
The Rules Committee’s recommendation unanimously rejected that proposal. Supervisor Ross Mirkarimi argued that while requests for metadata might be a nuisance to city officials, the city is still responsible for providing “all native data” to the general public that is consistent with the Sunshine Ordinance. When Supervisors Tom Ammiano and Sean Elsbernd agreed, room 263 at City Hall erupted with applause.
“The fact is that we’re entitled to see all public information that is not exempt,” Grossman told us. “To the extent that public information is buried in the other data, the metadata, we’re still entitled to see it.”

Mayor Gavin Newsom has long been considered a lock for reelection next year, a belief driven by his same-sex marriage gesture, hoarding of political capital, personal charm, and high approval ratings. Yet Guardian interviews with more than 20 political experts and insiders from across the ideological spectrum indicate that Newsom may now be more vulnerable than ever.
Just as San Francisco politicians are starting to calculate whether to run, the Newsom administration has suffered a series of political setbacks. In November alone, most of Newsom’s picks got spanked during the election, his veto of popular police foot patrol legislation was overridden by the Board of Supervisors, and he was caught off guard by the San Francisco 49ers’ announcement that they were moving to Santa Clara, taking with them Newsom’s hopes of landing the 2016 Summer Olympics.
“Until recently, I didn’t have a lot of hope,” Sup. Chris Daly, whom Newsom unsuccessfully worked to defeat, told us. “Now the progressives have a glimmer of hope. The mayor seems to be hurting from three or four episodes where he was caught with egg on his face.”
To many political observers — most of whom the Guardian allowed to speak anonymously in order to capture their most candid observations and plans — the defeats were indicative of a mayor who seems increasingly disengaged and out of touch. Even Newsom’s strategy of avoiding fights that might hurt his popularity has rankled many of his allies, who complain that this risk-averse approach has allowed the Board of Supervisors to effectively set the city’s agenda.
“This guy does not use one scintilla of his political capital on anyone or anything,” said former mayor Art Agnos, whose name has been dropped as a possible challenger to Newsom but who told us, “I’m not running.”
There are a number of strong anti-Newsom narratives out there, even on his signature issues, such as crime and homelessness, which persist as visible, visceral problems despite increased city spending on homeless services and controversial tactics like police sweeps and one-way bus tickets out of town for vagrants.
The mayor started his term by announcing during a radio interview that if the murder rate rose, he should be ousted from office. It did — remaining at 10-year highs through the past three years — handing his potential opponents a ready-made sound bite. The crime rate could be a powerful weapon when paired with Newsom’s failure to follow up on promises of police reform.
Newsom is still likely to offer up a long list of accomplishments in his usual statistics-laden style. But much of what he tries to take credit for was actually someone else’s initiative, such as the universal health care measure crafted by Sup. Tom Ammiano (who is running for the State Assembly and not taking a third run at the mayor’s office). Adding to Newsom’s problems in November was the lawsuit the Golden Gate Restaurant Association — a Newsom ally — filed challenging the measure.
Almost everyone we interviewed agreed that if Newsom does have approval ratings of around 80 percent, as has been reported, that support is very soft and may significantly erode during the campaign. “His support is an inch deep and a mile wide” was how one political analyst put it.
“His ‘skyrocketing’ approval rating is irrelevant,” one downtown politico told us. “People approve of the mayor like they approve of the color beige. If you fill an arena with 50,000 people and ask them to decide on what color to paint the walls, that color will always be beige. It’s not that they necessarily like beige; it’s that they will accept it as long as those freaks who want hot pink don’t get their way.”
And then there are his personal foibles. Newsom’s choice of girlfriends — from the Scientologist actress to the 19-year-old hostess — has found its way into print and caused the mayor to lash out in brittle ways that have hurt his relations with once-friendly outlets like the Chronicle, which openly mocked Newsom’s televised comments last month about how hard his job is and how he might not run for reelection.
Finally, there are the new electoral realities: this is the first mayor’s race in which challengers will receive public financing from a $7 million fund (almost all of which, Newsom campaign manager Eric Jaye argues, will be aimed at doing damage to Newsom) and the first with ranked-choice voting, allowing candidates to run as a team and gang up on the mayor.
Add it all up, and Newsom looks vulnerable. But that’s only the first part of a two-part question. The trickier part is who can run against Newsom, and that’s a question to which nobody has any good answer yet.
THE FIELD
Among the names being dropped for a mayoral run are Dennis Herrera, Aaron Peskin, Ross Mirkarimi, Matt Gonzalez, Kamala Harris, Mark Leno, Agnos, Susan Leal, Angela Alioto, Lou Girardo, Warren Hellman, Jeff Adachi, Tony Hall, Leland Yee, Daly, Michael Hennessey, Quentin Kopp, and Carole Migden. That’s quite a list.
Yet most say they are disinclined to run this time around, and none are likely to announce their candidacies in the near future, which is when most observers believe a serious run at Newsom would have to begin. Here’s the catch-22: nobody wants to run against Newsom unless his approval rating sinks below 60 percent, but it’s unlikely to sink that low unless there are rivals out there challenging him every day.
Two candidates who already hold citywide office and could aggressively challenge Newsom on police issues are Sheriff Hennessey and District Attorney Harris, both of whom have mainstream credentials as well as supporters in the progressive community. But both have expressed reluctance to run in the next mayoral election, at least in part because they’re also standing for reelection this fall and would need to leave their jobs to run for mayor.
Public Defender Adachi is a favorite of many progressives and could also run on police reform, but his job of representing sometimes heinous criminals could be easy for the Newsom team to attack Willie Horton–<\d>style.
Many of the strongest potential candidates are thought to be waiting four more years until the seat is open. City Attorney Herrera can take as much credit as Newsom for gay marriage and is a tough campaigner and formidable fundraiser who has clearly been setting himself up for higher office. Assemblymember Leno has won over progressives since his divisive 2002 primary against Harry Britt and could be mayoral material, particularly because he’s termed out in two years. But both are allies of Newsom and reluctant to run against him.
Several supervisors and former supervisors would love to beat Newsom, but the road seems steep for them. Daly just got beat up in his own reelection, so his negatives are too high to run again right now. Supervisor Mirkarimi might run, but some consider him too Green and too green and are urging him to wait four more years. Board President Peskin could also be a contender, but some doubt his citywide appeal and note a few bad votes he’s cast.
Challenges from Newsom’s right could include Kopp, the former legislator and judge; Hall, the former supervisor whom Newsom ousted from his Treasure Island post; businessman and attorney Girardo; financier and philanthropist Hellman; and Alioto, who ran last time. But these would-be challengers are generally less liberal than Newsom, who pundits say is as conservative a mayor as a town with an ascendant progressive movement will tolerate.
Finally, there’s Gonzalez, who four years ago jumped in the mayor’s race at the last minute, was outspent by Newsom six-to-one, and still came within less than five percentage points of winning. Many progressives are urging him to run again, noting that he is still popular and has the political skills to highlight Newsom’s shortcomings. But Gonzalez remains cagey about his intentions.
“I don’t believe I’m running for mayor. The chances are slim,” Gonzalez told us. “But I think he needs to be challenged.”
TEAM NEWSOM
Newsom campaign manager Jaye says he’s definitely expecting a challenge. And unlike most observers whom we spoke with, who are surveying the field and not seeing many people jumping in, Jaye expects a crowded free-for-all and a tough race.
“Is it likely to be a highly contested mayor’s race? Sure. Is that a good thing? Yes, I think it is,” Jaye said. “Every race in San Francisco is tough. The school board races here are fought harder than some Senate races.”
But Jaye thinks the new public financing system — in which mayoral candidates who can raise $135,000 will get $450,000 from the city — will be the biggest factor. “That’s one of the reasons I think everyone’s going to run,” Jaye said. “That guarantees it will be a crowded field.”
One political analyst said that’s the best scenario for defeating Newsom. He said dethroning the mayor will be like a pack of jackals taking down an elephant. No single challenger is likely to beat Newsom, but if he’s being attacked from all sides, he just might fall.
As for Newsom’s weaknesses and missteps, Jaye doesn’t agree the mayor is particularly weak and doesn’t think people will turn away from Newsom because of his candid comments on how the job cuts into his personal life.
“One of the reasons so many people like Gavin Newsom is he’s not afraid to be human in public and to be honest,” Jaye said, adding that his candidate is up for the challenge. “He is running for real and will run a vigorous race.”
Jaye concedes that the 49ers issue is difficult: Newsom will be hurt if they leave, and he’ll be hurt if he appears to give up too much to keep them here. The high murder rate and inaction on police reform are widely considered to be vulnerabilities, but Jaye said, “Gavin Newsom gets up every day and works on that problem, and if voters think another candidate has a better solution, they’ll look at it.”
Everyone agrees that candidates will enter the race late — which is what happened during the last two mayor’s races and is even likelier with public financing. If Newsom takes more hits or can’t get his head into the game, the sharks will start circling. “The next three months with what happens with the mayor will be telling,” another political insider told us.
One test will be with Proposition I, the measure voters approved Nov. 7 asking the mayor to show up for a monthly question time before the Board of Supervisors. Newsom reportedly has said he won’t come, which could look cowardly and out of touch to the voters who approved it and to the supervisors, who might make great political theater of the no-show. And if Newsom does decide to show up, most observers believe he might not fare well in such an unscripted exchange.
If Newsom implodes or appears weak in late spring, suddenly all those political heavy hitters will be forced to think about getting in the fray. After all, as just about everyone told us, nine months is like an eternity in San Francisco politics — and Newsom has the best job in town.

It sucks to be in jail. Trust me on this.
I’ve never been in a state prison, but I’ve done my time — in small stretches — in county, mostly for political protests, and while it all seemed so noble ahead of time and may sound noble in retrospect, when I was there it wasn’t anything except really shitty.
I was a white guy locked up for nonviolent crimes that even the authorities didn’t take too seriously and never had to stay for more than 10 days. I was never in a high-security unit or stuck with really hardcore criminals. In fact, the time I was in Santa Rita, as a guest of Alameda County, I’d been arrested with Cecil Williams, who was almost a minor deity to many of the inmates, so nobody even thought of treating us white protesters with anything but respect.
Still: it sucked.
You get up every morning and look out the heavily fortified windows to see a world from which you are utterly separated. You have no control over your life — you eat, sleep, work when you’re told. You walk where the guards tell you to walk. There is no privacy. You’re being watched all the time. A lot of the rules are totally random and are often enforced the same way; you can’t get any answers to anything, including what you may have done wrong.
By about my fifth day at Santa Rita, I had lost all sense of the righteousness of my cause. I just wanted to get the hell out of there. My only source of comfort was that I knew when my time would end.
Josh Wolf doesn’t even have that. He’s stuck in a federal pen because he won’t turn over to the authorities videotapes of a demonstration. It’s not like a 10-day or six-month sentence either: he has to stay until either he turns over the material or the grand jury that subpoenaed it dissolves. The jury’s term ends in July, but the US attorney can simply empanel a new one, renew the subpoena — and put Wolf back in jail again.
It’s a terrifying situation for a 24-year-old who never set out to be anyone’s hero or standard-bearer. I can’t imagine what it must be like. The temptation to just give up and turn the stuff over must be overwhelming. I give the guy immense credit for sticking it out and standing up for an important journalistic principle.
Wolf clearly isn’t going to get any help right now from the judicial branch. The Ninth Circuit Court of Appeals has just rejected his final motion and announced that it won’t accept any more filings in the case.
The Society of Professional Journalists did its part by naming Wolf one of its journalists of the year. Supervisors Ross Mirkarimi and Chris Daly pushed a resolution supporting him. There might be another angle for the supes, though: this entire case exists because the San Francisco Police Department brought in the feds to investigate an anarchist rally at which a cop was hit in the head. Could the board direct the SFPD to officially revoke its request and inform the US Attorney’s Office that it no longer wants the video? Can the city officially close its investigation and tell the feds to close theirs too? At the very least, the supes should look into it. SFBG

The word on the street is that Johnnie Carter has passed John Rizzo for a seat on City College’s Board. According to Ross Mirkarimi’s aide, Boris Delepine, on Friday Carter was up 100 votes and angled to take the third available seat on the Board. The final results of the ballot count will be out on Tuesday.

The devil in the metadata

The Rules Committee of the Board of Supervisors is considering whether or not the city should allow its departments to release electronic documents that include metadata. Although the Sunshine Ordinance Task Force has already hashed over the minutiae of this issue and ruled that metadata can and should be released, the mystery enshrouding what it is, and the lack of any specific policy or known precedent in other cities or states with public records laws has pushed the discussion upstream to where a formal legislation has become a possibility.
Freedom of information purists are saying all the parts and pieces of a document are part of the public domain, while the City Attorney’s Office is claiming another layer of protection may be required.
Metadata entered the realm of public discussion in San Francisco after citizens started making requests of electronic documents with a specific plea for metadata. Activists Allen Grossman and Kimo Crossman wanted copies of, ironically enough, the city’s Sunshine Ordinance, in its original Microsoft Word format. Grossman and Crossman wanted to use the advantages of technology to follow the evolving amendments the Sunshine Ordinance Task Force members were considering for the city’s public records law. These “tracked changes” are a common function in Word, and are, technically, metadata.
When Clerk of the Board Gloria Young received these specific requests for Word documents, not knowing what this “metadata” was or what to do about it, she turned to the office of City Attorney Dennis Herrera for advice.
Deputy City Attorney Paul Zarefsky initially gave oral advice to Young, and when pressed by the Sunshine Ordinance Task Force, issued a five-page memo in response, arguing that release of documents with metadata could pave a path for hackers into the city’s computer system, render documents dangerously vulnerable to cut-and-paste manipulation, and invite another unwelcome burden of reviewing and redacting for city officials. Young followed his advice and proffered the requested documents as PDFs.
A PDF, or “portable document format,” is essentially a photograph of the real thing, and contains none of the metadata that exists a couple clicks of the mouse away in a Word document. Evolving changes can’t be tracked, and PDFs don’t have the same searchability that Word docs have. So PDFs of the Sunshine Ordinance that Young provided didn’t have the functions that Crossman and Grossman were looking for, and were utterly useless for their purposes.
“It’s 92 pages,” Grossman said of the PDF Sunshine Ordinance. “I can’t search it electronically if I want to find something. This document I received is of no use to me.”

Meta-what?
Before delving too deep into the intricacies of current city politics, let’s pause for a moment to note that you don’t need to be a Luddite to have no idea what metadata is. It sounds like some diminutive or ethereal version of the real thing. In a sense, it is.
Simply put, metadata is data about data, and grows with weed-like tenacity in the electronic flora of the twenty-first century. Common examples include the track an email took from an outbox to an inbox, details about the owner of a computer program, or the laptop on which a Word document has been typed.
Metadata becomes cause for concern when there is something to hide. Not readily visible, metadata requires a little sleuthing to reveal, but in the past it’s been used to uncover deeper truths about a situation. For example, attorney Jim Calloway relates on his Law Practice Tips blog a divorce case where custody of the child was called into question because of the content of emails sent from the mother to the father. The mother denied she’d sent the emails, though the father vehemently insisted she had. A court forensics investigation found metadata showing that, in reality, the father had written the emails and sent them to himself.
“Metadata speaks the truth,” Calloway writes. “My position has always been that a tool is a tool. Whether a tool is used for good or evil is the responsibility of the one who uses the tool.”
Lawyers have historically advised that metadata be fiercely protected. Jembaa Cole, in the Shidler Journal for Law, Commerce and Technology wrote, “There have been several instances in which seemingly innocuous metadata has wreaked professional and political havoc.”
Cole goes on to cite a gaffe from Tony Blair’s administration – a document about weapons of mass destruction was available on the government’s web site, which claimed the information was original and current. Metadata showed that, not only had the information been plagiarized from a student thesis, it was more than ten years old.
Cole urges lawyers to take an aggressive tack against revealing metadata, by educating offices about its existence, making a practice of “scrubbing” it from documents, and providing “clean” documents in PDF or paper form.
The city attorney’s office has taken a similar stance. Spokesperson Matt Dorsey told us metadata has been a part of the continuing education of the city attorney’s office. However, all past case law of which they are aware focuses on metadata in the context of discovery and “the conclusion of most state bars is that they have the obligation, under attorney-client privilege, to review metadata prior to discovery,” he said. “The issue of metadata is a relatively new one in legal circuits. It isn’t a brand new issue to us, but it is in the context of Sunshine,” said Dorsey, who maintains that metadata could still fall within the standard redaction policies of the public records act.
Terry Franke, who runs the open-government group Californian Aware, argues that “the city attorney needs to complete this sentence: ‘Allowing the public to see metadata in Word documents would be a detriment because…’ What?”
“From the beginning of this discussion the city attorney has never provided a plausible, practical, understandable explanation of what is the kind and degree of harm in allowing metadata to be examined that justifies stripping it out,” Francke said.

To the task force
When Grossman and Crossman were denied the documents as they’d requested them, they filed complaints with the Sunshine Ordinance Task Force. In their cases, first heard on Sep. 26, they argued there should be no concern that the text of Word documents could be manipulated – anybody with a gluestick and a pair of scissors could do that to any piece of paper. That had been a consideration when the Sunshine Ordinance was drafted, and why the city always retains the undisputable original.
Thomas Newton, of the California Newspapers and Publishers Alliance, who was involved in drafting the state’s public records law, agreed with them. “If you follow his logic, you can’t release a copy of any public record because, oh my God, someone might change it,” Newton told us.
Crossman and Grossman also pointed out that to convert documents from Word to PDF invites even more work to a task that should be as burden-free as possible. It’s a regular practice for the clerk of the board to maintain documents as PDFs because that preserves signatures and seals of ratified legislation, but to make it a policy of all departments could invite a landslide of work, printing out documents and converting them to PDFs – not to mention undermining the notion of conserving paper.
Also, translation software and the “screen reader” feature that a blind person might employ to “read” an electronic document, don’t work with PDFs.
First amendment lawyers also offered written opinions on the issue. “Some of the city’s arguments have no support in the law whatsoever,” wrote Francke. “The fundamental problem for the city is that it has no authority to legislate a new general exception of exemption from the CPRA (California Public Records Act), and that’s what’s being advanced here.”
“The city’s scofflaw position represents the status quo ante, the old law that used to allow an agency to provide a copy of computer data ‘in a form determined by the agency.’ The city’s position has been directly and completely repudiated by the legislature. If the city disagrees with the law, it should come to Sacramento and get a bill,” wrote Thomas Newton, general counsel for the California Newspaper Publishers Association (CNPA).
As for the hacker scare, Zac Multrux, an independent technology consultant was invited to the Sep. 26 hearing by task force member Bruce Wolfe to speak about the dangers of metadata. He suggested a number of technological tools that are available for purchase or are free online, that will “scrub” metadata from documents. He said that while it’s true that someone with ill intent could mess with metadata, “I think someone would need a whole lot more than the name of a computer” to hack into the city’s system. “Personally, I don’t see it as a significant security risk,” he said.
It was also pointed out at the hearing that a variety of city, state, and federal departments already make Word and Excel documents available. Wolfe did a quick online search and found more than 96,000 Word documents on the State of California web site. “They’re not afraid to make Word documents public online,” he said.
Over the course of two hearings the task force found no basis for Zarefsky’s claims in either the city’s law or the California Public Records Act – both of which explicitly state a document should be released in whatever format is requested, as long as the document is regularly stored in that format or does not require any additional work to provide.
The task force found Young in violation of the ordinance and she was told to make the documents available in Word format. No restrictions or rulings were made for future requests, but task force member Sue Cauthen said, “I think this whole case is a test case for how the city provides documents electronically.”

What’s next?
As requested, Young had the Sunshine Ordinance, in Word format, pulled from the city’s files and posted on a separate server outside of the city’s system to be viewed. Crossman, noting the added labor and resources for that provision, wondered if that would happen to all public records requested in Word format, so he cooked up another request to test his theory.
He asked for all the pending and accepted legislation for the month of September from the Board of Supervisors, in Word format.
While the Sunshine Ordinance Task Force had found that withholding documents because of metadata was against the law, redaction of privileged information is still legally necessary, and Young continued to follow the city attorney’s advice that a PDF with no metadata was still the safest, easiest way to comply. She told us, “I don’t take their advice lightly.”
Zarefsky’s opinion said departments “may” provide PDFs instead of Word documents and that “metadata may include a wide variety of information that the City has a right — and, in some cases a legal duty — to redact. Young’s office does have pending legislation in Word format, she says it does not fall within the expertise of her staff to review and redact the metadata in those documents because they didn’t author them. “Since we don’t create the documents, how could we ever know whether the metadata should be released? We don’t know what it is,” she told us. “We couldn’t even hire expertise that would know.”
“I can’t imagine there’s so much toxic stuff in Board of Supervisors records they can’t let out,” Grossman told us. “This is a whole mystery to me.”
“It’s just data,” says Crossman. “City employees created it on our dime. Unless it falls under redaction discretion, entire documents should be provided.”
Young took the issue to the legislators who do draft the legislation, asking the November 2 meeting of the Rules Committee for further policy consideration. Miriam Morley spoke on behalf of the city attorney’s office, and said there was a sound legal basis for providing documents as PDFs, but that this was an evolving area of the law that the city attorney’s office wasn’t aware of until about 9 months ago. They could find no other cities currently grappling with the issue, but she said, “Our conclusion is that a court would likely hold a right to withhold a document in Word.”
The committee decided to research the issue further before making a ruling. Committee chair Ross Mirkarimi said he had been integral to the drafting of the Sunshine ordinance, and to rush a decision could be detrimental.
“It seems to me in the spirit of the Sunshine law this is something we should really look at,” Tom Ammiano said. It’s currently at the call of the Chair of Rules and no date has been set for the Rules Committee to hear it again.
A policy in San Francisco could set a real precedent for public records law, but according to many first amendment lawyers, for the Board to do so would be a violation of state law. “I know of no other city, county, or subdivision of state government or state agency that’s disregarding the clear intention of the law as some elements of San Francisco city and county government are planning to do,” Newton told us.
“It’s a debate that can’t really occur outside of a proposal to change the state law,” he said. “The Board of Supervisors can’t pick and choose which law to comply with,” and he said the state’s constitution and public records act trumps the city, which is reading the law too narrowly. “They’re required to give a broad interpretation of this access law. If they don’t like it they should come to Sacramento and get a bill,” he said.
“I think a lot of city departments, and policy and advisory bodies can save themselves a lot of headaches by declaring as policy that they will provide documents in their original formats,” task force member Richard Knee said. “With metadata.”

Board overrides Mayor’s foot patrol veto

It hasn’t exactly been a good couple of weeks for Mayor Gavin Newsom.
His picks for Board of Supervisors got thumped.
The 49ers said they’re running away with Santa Clara but keeping San Francisco’s name.
Newsom nix sayed the city’s Olympic bid
And then the Board of Supervisors overrode Newsom’s veto of police foot patrol legislation in a 9-2 vote that means the city will go ahead with a one-year citywide pilot project.
Worse, the nine sups that defied his veto got to explain their reasons, which included slamming the mayor and the police chief for lack of leadership..
Sup. Ross Mirkarimi talked about giving the mayor and Chief of Police plenty to time to take action. When they didn’t, and the Board took the lead, Mirkarimi says he was surprised by the mayor’s veto.
As for SFPD Chief Heather Fong’s hastily announced counter plan, which was made public on Monday, Mirkarimi said, “An acute difference between the two plans is that ours calls for accountability.”
Sup. Bevan Dufty, citing increased incidences of violent crime and inadequate response in the Castro, said “the visible presence of foot patrols is helpful.”
“No one is higher than the chief of police but the chief needs to speak up and to speak clearly without regard for where the chips may fall,” said Dufty, alluding to a lack of morale in the SFPD. “This vote is not offered as a criticism of the Mayor or the Chief. This is the best we can do as a Board right now. Let us rise above that and recognize that we need leadership.”
Sup. Chris Daly couldn’t resist asking how the increased number of officers under the Chief’s plan (44 isntead of the 33 specified in the Board’s plan) “isn’t playing politics.”
Sup. Tom Ammiano wondered what kind of cooperation will be forthcoming, and Sup. Fiona Ma noted that if there was a garbage problem or a flu epidemic, this board would propose a plan, which is why the board reacted to crime wave with foot patrols.
Sup. Michela Alioto-Pier, who along with Sup. Sean Elsbernd voted to uphold the mayor’s veto, said one of the problems was the way the ordinance was written.”
Elsbernd argued that the mayor and police chief should make policing decisions, not the Board of Supervisors.
But Sup. Gerardo Sandoval was upset that SFPD Chief Heather Fong had said that if the Board overrode the mayor’s veto, she didn’t want to disobey the Board’s legislation, but her captains might ignore it.
“We need to be very protective of our roles in this city,” Sandoval told his colleagues.
“To have a Chief of Police say something like that should not go unnoticed.”
Sup. Sophie Maxwell, noting that she probably has the highest incidence of gun violence in her district, recalled walking the precincts this fall and people telling her that they wanted to see the police,
“I have no choice. I have to do this,” said Maxwell of supporting the legislation.
Board Chair Aaron Peskin, who previously voted against the Board’s legislation, but ultimately voted to support it found it ironic that the legislation embraced by the police and the mayor “supports the Board’s idea.”
Sup. Jake McGoldrick found the SFPD’s counter proposal, “a day late, a dollar short.”
“For 5 months, 7 months, 18 months , we were looking for tools, all we got was reaction, not action. But there’s something hopeful about this dialogue.”
After the historic vote, SFPD Chief Heather Fong told the assembled media that she would disagree about their being a morale problem in the department.
Acknowledging that the SFPD is currently 300 officers under its mandated staffing levels, Fong said, “ I believe the captains have to have flexibility.”
Noting that the SFPD’s plan would kick in Nov. 24 and involve 44 officers, Fong added,” I believe the deployment plan will be incompliance with the legislation.”
As for the mayor, it would have been interesting to be a fly on the proverbial wall of his office.

Turning point

It’s amazing what the New York Times can find newsworthy. On a night when progressives in San Francisco racked up an impressive list of victories — and the popular mayor, often described as a rising star in state and national politics, got absolutely walloped — the nation’s newspaper of record led an online report on city politics with this gem: “A bike-riding member of the Board of Supervisors apparently won re-election while his wife was reported to have screamed an epithet at opponents.”
The Times story, by Jesse McKinley, called it “just another night in San Francisco’s iconoclastic politics,” meaning, apparently, that only in this city would a politician ride a bicycle and only here would a politician’s wife use foul language in public.
Please.
For the record: Sarah Low Daly — who watched her husband, Chris, get pummeled mercilessly for weeks by brutal attack ads paid for by, among others, the Golden Gate Restaurant Association — did dismiss “those motherfuckers” with a colorful epithet that no less than the vice president has used on the floor of Congress but that can’t ever appear in the New York Times.
But allow us a little context here.
Daly’s wife had every right to celebrate on election night — and every right to slam the forces that were so unwilling to accept a living wage for local workers, sick pay for employees, requirements that developers pay for affordable housing, and the rest of Supervisor Daly’s progressive agenda, which had made him the subject of a Karl Rove–style smear campaign.
And the Times (as well as the embittered blogger at the San Francisco Sentinel who leveled personal insults at the supervisor’s wife) utterly missed the point of what went on in San Francisco last week.
This was a watershed in city politics, an election that may turn out to have been every bit as important as the 2000 ballot that broke the back of the Brown-Burton machine. It was evidence that district elections work, that downtown money doesn’t always hold the day — and that Mayor Gavin Newsom made a very bad political mistake by aligning himself with some of the most intolerant, unpleasant, and ineffective forces in local politics.
NEWSOM THE LOSER
We ran into Newsom’s press secretary, Peter Ragone, the day after the election and asked him the obvious question: “Not a very good night for the mayor, huh?”
It was a hard point to argue: Newsom put immense political capital into two key races and was embarrassed in both of them. He worked hard for Rob Black, the downtown candidate trying to oust Daly in District 6, showing up at Black’s rallies, walking the streets with him, talking about the importance of the race, and helping him raise funds. His handpicked contender in District 4 was Doug Chan, a former police commissioner. Black lost by 10 percentage points; Chan finished fourth.
And a long string of progressive ballot measures that the mayor had opposed was approved by sizable margins.
Ragone began to spin and dissemble like crazy. “We endorsed [Black and Chan] but didn’t put a lot into it,” he said despite the fact that Newsom spent the last two weekends campaigning for his two favorites.
“The real key for us was Hydra Mendoza, who won [a seat on the school board],” Ragone said.
Yes, Mendoza, who works as the mayor’s education adviser, was elected — but she already had a strong base of support as a former leader of Parents for Public Schools and might very well have won without the mayor’s help.
Besides, if Newsom saw her as a top priority, why did she finish second in a race for three positions, behind Green Party candidate Jane Kim? And how significant will it be to have Mendoza on a school board that now has a solid progressive majority, one she’s not a part of?
Ragone shrugged again, sticking to his line.
But the Mayor’s Office can’t spin away the fact that, as pollster David Binder put it at a postelection event, “I don’t think Newsom had a very good night.”
“It showed that we had a progressive turnout and this is a progressive town,” Binder said.
Boris Delepine, a campaign veteran and Sup. Ross Mirkarimi’s board aide, went even further: “This election ranks up there with the 2000 supervisorial races as far as I’m concerned.”
In other words, progressives battled the downtown interests and won.
The most exciting race was in District 6, where Daly’s expected reelection was thrown into doubt a few weeks ago by some polls and the onslaught of downtown attacks on Daly (which Binder jokingly referred to as “a deforestation project” for all of the negative mailers).
The problem was that most of the material just attempted to savage Daly without really making the case for why Black would be better. That appears to have backfired.
In fact, the assault served to galvanize Daly supporters, who stepped up a vigorous campaign in the final push. “It was very efficient and very effective,” Binder said.
Or as Daly put it to his supporters on election night, “We were under attack…. San Francisco values were under attack, and you responded like nothing before. Five hundred volunteers were in the streets today to say this district is not for sale.”
The message from the Tenderloin, inner Mission, and South of Market was resoundingly clear: with district elections downtown can’t simply buy a seat on the board anymore. Money is powerful — but an organized grassroots campaign can still prevail.
The impact for the mayor is more than just the loss of a potential board ally. Newsom found himself in District 6 working closely with SFSOS — a group that has become so nasty and is so reviled, even two of its key founders, Senator Dianne Feinstein and financier Warren Hellman, have walked away in disgust.
“If all things were equal, I’d just as soon that SFSOS went away,” Hellman told us.
It’s not going to help the mayor’s reputation to be seen in that sort of company.
A HIPPER DUFTY
The District 8 race showed the power of district elections in a different way.
From the start it was going to be tough for Alix Rosenthal, a straight woman, to defeat incumbent supervisor Bevan Dufty, a gay man in what has always been a gay district. But Rosenthal says her candidacy had a clear impact on Dufty — during the late summer and fall, the onetime solid mayoral ally moved a few noticeable steps to the left, supporting Sup. Tom Ammiano’s universal health care bill and voting with the progressives (and against the mayor) for police foot patrols.
“Dufty became a much hipper person after I challenged him,” Rosenthal said.
Dufty told us the challenge made him work harder but had no impact on his votes. “What you saw on foot patrols was an immense amount of frustration with the police chief’s failures to lead the department,” he said. “That had nothing to do with this race.”
Binder pointed out that District 8 has a higher percentage of registered Democrats than any district in the city, and Dufty locked down party support early on. And even though Dufty’s voting record was less progressive than his district, he remains popular. “There are people who think he doesn’t vote the right way on the issues, but nobody thinks he doesn’t try hard,” Binder said.
The District 4 race was not only a test of the power of the mayor’s coattails in a district where Newsom has always been popular. It was also a test of how ranked-choice voting works in complex election demographics.
From early this year, when it became clear that incumbent Fiona Ma was going to the state assembly, Newsom and his allies tapped Chan as the candidate they would promote. That was an odd choice for Newsom, who claims to be a public power supporter: Chan’s law firm has received more than $200,000 in legal fees from Pacific Gas and Electric Co. in just the past two years, and like his alliance with Black in District 6, the Chan endorsement put him on the side of one of the least popular actors on the local political stage.
And in the end, the mayoral support meant little: Chan finished fourth, after Ron Dudum, Ed Jew, and Jaynry Mak.
There was a certain amount of nervousness on election night when Dudum emerged atop the candidate list at the prospect that for the first time in a generation, the board would be without Asian representation. Four Asian candidates appeared to have split the vote, allowing Dudum to win.
But when the ranked-choice voting program was run Nov. 10, that concern evaporated: the new system allowed Asian voters to divide their preferences without risking that sort of vote-split result. When it was all over, Ed Jew emerged the winner.
As Jew told us, “I think it showed that having so many Asians benefited the top Asian vote-getter.”
GREEN DAYS
The school board and community college board races get less press than the top of the ticket, but as citywide contests, they can be even tougher for progressives. And this year the Green Party had some surprising victories.
Jane Kim, a Green, finished top in the balloting — remarkable considering that she didn’t have the endorsement of the Democratic Party. Mendoza came in second, followed by Kim-Shree Maufas. That puts three new members, all of them women of color, on the board and shows that activists frustrated by the votes of longtime incumbent Dan Kelly could defeat someone who until recently was considered a shoo-in for reelection.
Peter Lauterborn, a Kim supporter, was ecstatic about the win. “This is a massive triumph,” he said. “We beat the money and we beat the establishment.”
The same goes for the community college board, where John Rizzo, a Green, appears to have edged out Johnnie Carter, bringing new reform blood to an ossified and often corrupt agency.
Binder attributed the strong finishes by Kim and Maufas to their endorsements by the Guardian, the Democratic Party, and other lefty supporters. He was surprised by Rizzo’s apparent victory (absentees could still change the outcome) but most on the left weren’t. Rizzo had a lot of grassroots support and ran a strong campaign.
Similarly, Mirkarimi — who attended the postelection briefing along with fellow supervisor Daly — didn’t agree with Binder’s line on the school board, noting that the defeat of Kelly and the election of Kim and Maufas were strong endorsements for the stand that the current board lefties — Mark Sanchez, Sarah Lipson, and Eric Mar — have taken against positions by autocratic former superintendent Arlene Ackerman and her downtown backers.
“We got four votes on the school board,” was how Delepine put it, adding, “President Sanchez, man.” SFBG

What’s with the pot bill?

Sup. Tom Ammiano has a real simple measure coming to the board that ought to pass unanimously. It’s worked fine in Berkeley for many, many years. It works fine in Seattle, Santa Cruz, and Santa Barbara. And yet, it faces what could be a tight board vote and a mayoral veto. Crazy.

What Ammiano wants to do is make enforcing the marijuana laws the city’s lowest police priority. We’re just talking about possession laws, not sales. The city’s narcotics cops say it won’t be a problem. It will just send a message to the chief and the street patrols that they should worry more about violent crime than about busting someone smoking a joint in the park.

So far, Ammiano can count Sups. Jake McGoldrick, Chris Daly, Ross Mirkarimi, Aaron Peskin, Gerardo Sandoval and himself in favor. That’s six. But Mayor Newsom will probably veto it, so he needs two more.

Bevan Dufty and Sophie Maxwell really ought to get behind this.

Newsom fights veto override

With the Board of Supervisors set to vote Tuesday on the mayor veto of Sup. Ross Mirkarimi’s foot-patrol legislation, the mayor ‘s office has reportedly gone into overdrive to try to ensure his veto will hold .

The math is tough for Mayor Gavin Newsom: Supes Mirkarimi, Chris Daly, Tom Ammiano and Gerardo Sandoval are solidly behind the legislation. That’s four votes. Bevan Dufty, Sophie Maxwell and Fiona Ma all voted for it the first time around, when it passed 7-3, and all have spoken loudly in support of getting the cops out of their cars and into the neighborhoods. Jake McGoldrick was out of town for the vote, but he tells us he’ll side with the majority – which adds up to eight votes, enough to sustain a veto and deal the mayor an embarrassing political setback.

So Newsom is trying hard to get one of the eight to switch sides. Among the plays: Chief Heather Fong held a hastily arranged press conference Monday to announce her own, slightly watered-down foot-patrol plan, in a clear effort to undercut the supes. And we’re told that Senator Dianne Feinstein has been calling board members to lobby against the plan.

McGoldrick and Maxwell both told us that they were planning to vote to override the mayor’s veto, and chided Feinstein for getting involved. “If Feinstein wants to be mayor, she oughta run,” he said.

As for the police’s hastily announced foot patrol plan, Maxwell said, maybe it would be fine, but it was coming too late for her to backpedal.

“The mayor and Heather Fong had ample time. Why did we even get to this point? Because we’ve been asking and asking and finally we came up with legislation. The police have promised things before and didn’t do anything, so this isn’t the time for me to be backpedaling.”

Reached Friday Nov. 10, Dufty told the Guardian that he’s “always supported foot patrols” and has “no confidence” in Fong. But three days later, when Fong was promoting her alternative, all Dufty would say about his vote was, “no comment”

The wildest rumor had Newsom offering to fire Fong if some of the supes would back away from the veto override. The Mayor’s spokesperson, Peter Ragone insisted to us that “There’s no truth to that.” Then his line mysteriously went dead.

So who else could be the swing vote the mayor needs to keep his vanity intact?

Well, on Oct. 24, when the bill was approved, Sean Elsbernd, Michela Alioto-Pier, along with BOS chair Aaron Peskin voted against it.

Elsbernd and Alioto-Pier are known to be solidly in the mayor’s court. But what about Peskin?

Reached Monday night, Peskin wasn’t about to give up his voting plans, but he did say that he found it disingenuous of the mayor to veto the measure on the grounds that the board shouldn’t tell a paramilitary organization what to do, then turn around and say that he, the mayor, was planning to go ahead with foot patrols anyway.

Either way, Tuesday’s 2 pm board meeting will be worth watching.

As Sup. Mirkarimi told the Guardian, “People have told me that the police’s press conference was surreal, strange and desperate. The only reason we’re even in this position is because of an absence of leadership on the part of the chief of police and the mayor. And now they have the audacity to say that their plan is better than ours.
Public safety should never be compromised because of the Mayor’s vanity and the chief’s inaction. It’s an unreal, practically juvenile situation.”

The SFPD will not reform itself

EDITORIAL Mayor Gavin Newsom, who has vetoed legislation requiring a few police officers to actually walk beats in high-crime neighborhoods, says he was proud of the San Francisco Police Department’s action in the Castro on Halloween night. Proud? Some 800 cops were on hand, and yet someone managed to bring in a gun, shoot nine people — and get away. As we report on page 11, a lot of cops weren’t really doing much for most of the night except standing around; foot patrols (that is, cops actually mingling with the revelers, keeping an eye on things) might have prevented the shootings.
The SFPD is a mess — and the department isn’t going to reform itself. The mayor ought to be in the forefront on this, but he’s ducking — so the supervisors need to step up.
The foot patrol legislation, sponsored by Sup. Ross Mirkarimi, is hardly radical and isn’t a threat to the department’s independence. The bill simply directs the department to put a few cops on the beat, out of their cars, in a few high-crime areas. It passed 7–3, with only Sups. Aaron Peskin, Sean Elsbernd, and Michela Alioto-Pier dissenting, and Sup. Jake McGoldrick absent. If that vote holds and McGoldrick sticks with the majority, the supervisors can override the veto.
But there’s immense pressure coming down on individual supervisors to change their votes, and even one member slipping away would allow Newsom’s position to hold. That’s unacceptable: every supervisor who approved foot patrols needs to vote to override the veto — and just to be sure, Peskin, who is generally good on these issues, needs to come over to the progressive side. This one modest mandate could be not only a lifesaver in areas with high homicide rates but also the beginning of some real change at the SFPD.
The Police Commission is struggling with a disciplinary issue that’s also potentially a turning point: three commissioners — David Campos, Petra de Jesus, and Theresa Sparks — want to refuse to settle any disciplinary cases unless the cops agree to make the settlement public (see Opinion, page 7). Commissioner Joe Veronese initially agreed with that proposal but has shifted his position and is offering a really weak alternative instead. That’s a bad sign for the politically ambitious commissioner; he needs to show some spine, defy the Police Officers Association, and sign on with the Campos plan.
This just in: Bill Lee, who works for Mayor Newsom and (sort of) for the airport, is up for reappointment as a planning commissioner at the Rules Committee on Nov. 9. It’s a clear conflict of interest: a city employee working directly for the mayor shouldn’t be on the Planning Commission. Besides, he’s been a pretty bad vote. The supervisors should send him packing. SFBG

City hall’s new secrets

EDITORIAL Back in 1999 reporter Scott Rosenberg dug up a juicy little scoop for Salon: he found out that part of Microsoft’s annual report was written on an Apple computer. That caused the giant purveyor of Windows software (and Apple competitor) no small amount of embarrassment. And Rosenberg did this without any secret source or leaked records; he just looked at the metadata embedded in the files of public company documents.
Metadata is part of the new frontier of public-records law. It’s the stuff you can’t see that’s hidden in digital versions of, say, Microsoft Word documents. It shows what computer (and type of computer) created the document and often shows the revisions the document has gone through. It’s sort of an electronic history of what used to be something typed on paper — and as such, it’s extremely useful to researchers who want to follow what the government is doing.
It’s also, all too often, something that public officials want to hide. That’s the case in San Francisco, where Gloria Young, the clerk of the Board of Supervisors, has refused to release copies of the original Word versions of what are clearly public records. She wouldn’t, for example, give out a Word copy of the city’s Sunshine Ordinance.
That’s a mistake — and the Board of Supervisors needs to direct Young to change her policy.
Young isn’t refusing to release the records per se — she’s had them made into PDFs, the electronic equivalent of photocopies that don’t contain the embedded data. And she’s released those versions. The office of City Attorney Dennis Herrera concluded Sept. 19 that city officials have the right to withhold metadata and provide documents only in PDF format. The argument, contained in a six-page memo, goes more or less like this:
A Word version of a document can be edited and changed — and thus someone who requests a public record might alter it and then pass it off as a true version.
Besides, metadata might possibly contain privileged information (legal advice from an attorney). It might include early drafts of a document (which are exempt from disclosure but really shouldn’t be). And it might give somebody with evil intent the ability to hack into the city’s computer system and do a lot of damage.
In the end, deputy city attorney Paul Zarefsky argues, figuring out where there is and isn’t metadata and what it might include is a huge job that requires special skills and would be inordinately burdensome for city agencies.
The first argument is just silly. Sure, somebody could take a copy of a city record and alter it — but enterprising scammers have always been able to take real records and turn them into phonies. That’s why the city keeps the originals on file and releases only copies.
The rest of Zarefsky’s analysis is a bit more complex. But in the end the posture of the city is far too defensive. This is, after all, data that was produced by city employees on the taxpayers’ dime. And like just about everything else the city produces — with only narrow exceptions — it ought to be released to the public.
We don’t buy the argument that there are vast stores of deep secrets lurking in the metadata that might somehow damage the city’s interests. There may be a few specific cases in which documents have been reviewed by the City Attorney’s Office and might include confidential advice. But most of the material will simply show who created the document, how it was edited (and by whom), and how all of that relates to the final product. Like the Microsoft revelation, some of that might embarrass city hall — but that’s not an excuse to keep it secret.
Tom Newton, general counsel for the California Newspaper Publishers Association, noted in a Sept. 22 letter to the Sunshine Ordinance Task Force that the “CNPA is aware of no other state or local agency that has adopted this restrictive policy.”
Herrera’s office, interestingly, isn’t arguing that all metadata must be secret — the opinion only says that department employees have the ability to withhold it if they want to. That’s where the supervisors need to weigh in.
Young asked the Rules Committee on Nov. 2 for policy direction on the matter. The committee heard testimony and took the matter under advisement.
The chair, Sup. Ross Mirkarimi, should bring up the issue again at the next possible meeting, and the committee should direct Young — and all other city officials — to stop using metadata as an excuse to withhold documents. San Francisco ought to be taking the lead here and setting a policy precedent for cities across the state. SFBG
PS This is just one example of what seems to be a renewed war on sunshine at City Hall. The task force just had its budget cut and no longer has a full-time staffer assigned to it (although the Sunshine Ordinance mandates full-time staff assistance). The supervisors should make it clear that San Francisco isn’t going to slide backward into the old, dark days.

Newsom gets hammered

The big news of the night is that Mayor Gavin Newsom is taking a serious beating. The two candidates he invested the most time and political capital in — Rob Black and Doug Chan — are both going down to a clear defeat. In District 4, Chan has pretty much dropped off the map, with Ed Jew, Ron Dudum and Jaynry Mak locked in a close struggle for first place. This race will almost certainly come down to the IRV runoff.

“The mayor may be popular, but he has no coat tails,” Supervisor Ross Mirkarimi told me.

The bigger story is how little impact big money has had in district elections. If Daly pulls it out, and it looks like he will, and Chan loses, which is almost certain at this point, then it’s a sign that downtown really can’t buy district races.

The dirt in D6

› amanda@sfbg.com › sarah@sfbg.com If you live in San Francisco’s District 6, it’s pretty difficult to avoid what some residents are calling a new filth polluting Tenderloin corners and SoMa streets. It’s not overflowing trash bins or urine-stained door frames — it’s the relentless election billeting that uses those images to support Rob Black and oppose Chris Daly for the district’s seat on the Board of Supervisors. “We’re tired of talk. Of loud, whining, condescending, offensive, abusive, lying, showcasing, arrogant talk,” reads a recent poster on a telephone pole. “District 6 is dirty and dangerous. District 6 is still poor. Chris Daly is why. Dump Daly. Back Rob Black.” “I was totally offended by this,” Debra Walker, a progressive activist and resident of the district for 25 years, told the Guardian. “This kind of message intentionally suppresses the vote. People I’ve talked to in the district who aren’t very political are totally turned off by the mailings from Rob Black or made in his benefit.” Some of the mailings, posters, and literature can be directly attributed to independent expenditure (IE) committees recognized by the Ethics Commission and acting legally. Some, however, have more dubious ancestry but apparent links to a campaign attorney with a long history of using millions to control the outcome of elections in San Francisco: Jim Sutton (see “The Political Puppeteer,” 2/4/04). Sutton did not return calls for comment. Most of the anonymous literature directs people to the Web site www.DumpDaly.org. SFSOS’s Wade Randlett told us his group paid for the site and a volunteer set it up. SFSOS and Sutton formed Citizens for Reform Leadership 1–6 — IE committees listed on many of the signs and much of the literature, including the poster quoted above. The committees haven’t filed any IE reports with the Ethics Commission. Walker, along with Maria Guillen, vice president of SEIU Local 790, and another District 6 resident, Jim Meko, submitted a complaint with the Ethics Commission on Sept. 29 with nine pieces of physical evidence supporting their concern that the roof had been blown off the $83,000 spending cap on the campaign, in place because all candidates agreed to public financing. The evidence submitted with the complaint varied and included three different mailers from “Concerned Residents of District 6,” a committee that has yet to exist on paper in the Ethics Commission filing cabinets. The mailers from the “Concerned Residents” are glossy triptychs critical of Daly but not explicitly advocating for another candidate. They do not state the amount the committee paid for them, which is required of any electioneering communication. On Oct. 6 the Ethics Commission released a statement saying the spending cap for District 6 was no longer in effect. John St. Croix, executive director of the commission, has identified at least $90,000 in IEs, including three unreported mailers. “At some point we will attempt to determine who distributed the mailers,” St. Croix said. “But it’s not likely before the election.” The tactic of breaking the law before the election and taking the heat after the ballots are in has been used in the past, and this new example flouts recently passed legislation. These mailings should have been filed with the Ethics Commission, according to an ordinance passed in 2005 in response to similar anonymous hit pieces that came out in the elections of 2003 and 2004 against Supervisors Gerardo Sandoval and Jake McGoldrick. (Sutton defended SFSOS’s main funder, Donald Fisher, in his successful Strategic Lawsuit Against Public Participation against Sandoval over the issue.) “It’s a strategy taken straight from Karl Rove’s playbook,” Meko, a 30-year SoMa resident, told us. Joe Lynn, former Ethics Commission member and staffer, told us “all the committees in San Francisco should turn their backs on contributions from people who are involved in this scheme — at least until they explain their involvement. These are the most sophisticated folks in San Francisco politics. I think a full investigation including possible criminal activity ought to be assigned to a master.” He said District Attorney Kamala Harris used Sutton in her race and therefore may have a conflict of interest. The Rob Black for Supervisor committee claims no connection to the literature that hangs on doorknobs and clogs mailboxes, the push polls calling people, or the postings in the streets and tucked under windshields. “I don’t support the anonymous pieces. If people are doing it on my behalf, I don’t want it,” Black told us. But Daly told us “the IEs appear to be coordinated…. The Black committee is not running a campaign that would be independently competitive. He’s only sent one piece of mail, but he’s had eight sent on his behalf.” Residents suggest it’s even more than that: Walker received three more anti-Daly mailers Oct. 20. Black confirmed that he had only sent one mailing to the district, and he’s “not surprised” that so many IEs have sent out mailings in his support. With the exception of a filing from the Police Officers Association, the only legal IEs reported with the Ethics Commission so far are from the Building Owners and Management Association (BOMA) and Golden Gate Restaurant Association (GGRA). They also trace back to Sutton, Black’s former boss at Nielsen Merksamer, a law firm that represented PG&E in the 2002 campaign against public power, for which the firm was fined $100,000 for failing to report until after the election $800,000 from PG&E, the biggest fine ever levied by Ethics. Sutton left the firm shortly after. Black stayed on until 2004, when he took a position as legislative aide with Michela Alioto-Pier. The most recent poll released by Evans McDonough purports to show Black ahead by six points (with a five-point margin of error). It was commissioned by Barnes, Mosher, Whitehurst, Lauter, and Partners, which has also been employed by Sutton through BOMA and the GGRA for the IEs in the District 6 election. The financial shenanigans have been a rallying point for the Daly campaign. More than 70 volunteers signed in at an Oct. 21 rally and hit the streets: shaking hands, distributing literature, and making phone calls raising support for Daly. Sup. Ross Mirkarimi criticized the soft money’s “ugly, nasty, mean-spirited tactics” to oust Daly. “If they have to resort to these tactics, is that the kind of government we want in San Francisco?” he asked the crowd. “This is the nastiest, most personal and hateful thing I’ve ever been involved with,” Daly said. “It’s very painful.” But, he said, “our people power is better than their money power.” Outside a volunteer shouted into a bullhorn, “Don’t let downtown interests buy your democracy!” SFBG
