The Botticellis stick to the coast like gulls. Until recently, they all lived a few blocks from the ocean in an Outer Richmond flat, but drummer Zach Ehrlich decided to move into a beachfront apartment so he could have easier access to the surf. Before moving, he used a telescope pointed out his window to check for waves at Ocean Beach, but he gave that up after realizing the overall creepiness of the set-up, and he never could get to the beach in time to catch the waves he saw from his window.

Earlier this month, the band performed at Aqua Surf Shop on Haight Street. Beside surfboards propped against the walls and surf videos playing in the background, the Botticellis delivered a short set, bundled in sweatshirts and jackets against a door open to the San Francisco night. Afterward two men from the small crowd approached lead vocalist Alexi Glickman and said, "Dude, your music totally made us wanna surf." To Glickman, this was the ultimate compliment.

Their very name originates in surf culture — a botticelli is a tightly wound wave distinctive to the Southern California coast — but don’t assume the group is just a Beach Boys rip-off. While the Botticellis borrow from those hitmakers as much as any jangly indie-pop band does, their lyrics never come close to those of blatantly beach-themed tunes. The Botticellis are classier than that.

Glickman and Ehrlich grew up together in the Los Angeles area, where they developed a shared enthusiasm for music and surfing. They both began training in the Suzuki violin method in kindergarten, and have performed in original rock bands since age eight: first as an instrumental duo called Powerstrike, a recording of which Glickman says "sounds like Sleater-Kinney before Sleater-Kinney."

Now, almost two decades later, the pair is climbing toward indie stardom with their friends and fellow surfers Burton Li, Ian Nanson, and Blythe Foster as the Botticellis. Their new album, Old Home Movies, will be officially released next month on Antenna Farm Records. Local fans have a chance to grab an advance copy at their release party April 18.

Although they’ve begun headlining at SF’s larger clubs, they say they still prefer the lower-key atmosphere of spots like Aqua Surf. For these performances, the outfit brings their own sound system and mixes the vocals high to their soft-pop liking. "Every venue that we go to, we try to explain," Glickman said. "Usually people are totally unreceptive and say ‘Fuck you! Don’t tell me how to do my job!’ — which is probably why we like doing these house shows and small shows because we don’t have to go through some fucking huge PA system." With the vocals mixed down and the bass and drums cranked up, they metamorphose from a detailed, modern evocation of a ’60s pop group into a blaring indie-rock combo.

The Botticellis made a conscious decision to refine their sound: two years ago, they were a rock band with a self-released, self-titled EP showcasing guitar-driven power-pop. The transformation didn’t come easily. Some songs have been reworked and rerecorded multiple times before making it onto Old Home Movies. Seven of the new disc’s 10 tracks were laid to tape at Tiny Telephone in SF, and from the start, their goal was to re-create the crackly feel of a vinyl LP. They even toyed with the idea of releasing the recording on cassette before a quick survey of friends found that none of their pals owned a tape player.

"We were listening to Big Star records and Big Star side-project records, like Chris Bell," said Glickman. "We tried to get that sort of chewy analog mid-fi feeling." To round out that sound, the Botticellis sought out Matt Cunitz of SF’s Vintage Keyboard Repair for unusual instruments: Mellotron, folding pump organ, Minimoog, bassoon, and toy piano can all be heard at some point in the recording, beneath the fuzzy, light guitars. While Blythe Foster does not perform live with the band — she usually puts her voice toward work as an actress in local theater — the addition of her winsome vocals alongside the three male singers is nothing short of captivating.

The resulting Old Home Movies fully realizes the Botticellis attempts to bring wonder to the simplicity of California pop. And with summer coming, now is their chance to shine. One listen to Old Home Movies transports the listener back to a time when the state was known for cheerful sounds that matched clear skies. Still, the Botticellis aren’t deluding themselves. San Franciscans know that California isn’t all sun and fun, and the group’s nostalgic, delicate numbers match the melancholy nature that a July day in the Bay often holds. *

It may have been San Francisco’s Davies Symphony Hall, but at times it felt more like a Pentecostal revival meeting. Forget about rules or decorum: when the spirit moved them, this crowd let loose. Imaginary batons twirled. Heads tick-tocked. Feet tapped. Giggling and applause burst out at all the wrong times.

You haven’t really experienced the symphony until you’ve sat among 2,200 first and second graders at their first live orchestra performance, hundreds of them conducting the orchestra from their seats.

"Movement is exactly what we want," says Ronald Gallman, director of the San Francisco Symphony’s Education Programs, Youth Orchestra and Adventures in Music (AIM) program. "We wouldn’t be doing our jobs if they were sitting with their hands folded in their laps."

Not everyone acts like inspired little savages; others revel in acting like adults. One girl watched the performance through a pair of improvised opera classes — tiny binoculars she brought from an explorer’s kit at home.

It’s somewhat of a relief to learn that kids of the iPod generation can still appreciate classical music. It helps that musicians in the AIM program understand a few basic principles of child psychology: keep performances short, allow plenty of opportunities to shout out and move around, and throw in a fart joke or two for good measure (the tuba player who introduced his instrument with a flatulent blast got the biggest laughs of any joke in the performance).

Founded in 1988, the AIM program serves first through fifth graders at every public elementary school in San Francisco — an impressive 75 schools — as well as third through fifth graders in some private and parochial schools, totaling more than 22,000 children. Beyond the innovation, this is only possible because the AIM program is funded entirely by private donors, foundations, and events like the Black and White Ball — which means that it’s offered at no cost to the schools. According to Gallman, this level of commitment to building equitable access to music education in public schools makes the San Francisco Symphony stand apart as a national leader.

The symphony performance is just one piece of the larger AIM curriculum, which includes four ensemble shows per year at each school as well as comprehensive materials to help teachers build interdisciplinary lesson plans around the AIM performances. Each school is able to choose the ensembles it wants — with options including jazz and all varieties of world music — thus allowing for culturally appropriate programming at different schools.

At the Claire Lilienthal School in the Richmond District on a recent school day, the Drei Brass trio had been chosen to perform for a gymnasium full of first and second graders seated on the floor, each of whom had been given a brightly colored plastic kazoo.

"Our show today is about three brass instruments and vibration!" announced Alicia Telford, the Drei Brass french horn player, her eyes wide and one eyebrow arched. She showed the kids how to feel the vibration in their vocal chords when they sung by placing a hand on the front of their neck.

Each of the brass players introduced himself as "an ambassador of ppppfffft," demonstrating that the music coming out of their instruments begins with a simple pppfffft blown into the mouthpiece — the same ppppfffft sound that the kids blow into their kazoos.

They also peppered their classical performance with recognizable tunes that the kids could intuitively follow, like the finger-snapping Pink Panther theme.

Kazoo-induced hyperactivity aside, it seems that teachers by and large are nothing but grateful for the AIM programming in their schools.

"Music is a great way to keep some children engaged who might not be the best readers or [who are] a bit behind. It’s a great way to keep them in the school system through high school."

According to JR Jowkalsky, a reading teacher at Willie L. Brown Jr. elementary school in the Bayview, the number of students who pursue orchestra or band in middle school has "mushroomed" as a result of the AIM Program.

Keith Jones, who has been teaching for 20 years and currently runs the 40-piece band at Willie L. Brown, reports that about one-sixth of the potential band students participate in the music program. Anything over 10 or 15 percent participation is considered good.

"AIM has given me 10 violins, symphony tickets for the kids, concerts here at school," he said. "It provides things that I could never provide to my students."

While the AIM program alone cannot revive public-school music education in an era of restricted funding, it’s not a far stretch to say that exposing every single public school student by the end of fifth grade to five symphony visits and 20 ensemble performances must help pick up the slack.

Now, if only there was something AIM could do to preserve the sense of wonder and complete abandon with which these kids enjoyed the symphony for the first time, conducting wildly from their seats like no one is watching.

Fune Ya

HUNGER SET SAIL I must confess: I wasn’t planning to go to Fune Ya. I wanted to go to Namu, but couldn’t get a table (thanks, Paul Reidinger). Then I wanted to go to Burma Superstar, but after driving around the Inner Richmond for 45 minutes trying to find parking I wasn’t in the mood to wait twice that amount of time for food. So after buying a bunch of Peek-a-Poohs and Pocky from Genki’s Crepes, I walked a few doors down and saw a big banner in Fune Ya’s window: "Sushi Boat! $1.95 Rolls Special Promotion."

I love sushi boats for their interactive quality. We’re taught as kids to wait patiently; as adults, we’re taught that serious dining is a process of patience, of conversation in between plates. The whole point of a restaurant is to be served. But sometimes, as I walk starving through the restaurant to my table, I just want to grab food off the server window. I not only want what I order, but to pick off what everyone else ordered. Hence the sushi boat: you see, you want, you grab that shit. Ah, instant gratification.

Sushi boat sushi is never that good. It’s only decent when the restaurant is busy and the sushi is constantly replenished. On this visit, it was a Friday night, so everything was fresh. The shrimp tempura roll was delicately crunchy — not oily and soggy — and the shrimp was juicy and sweet inside. The spicy tuna with creamy sauce on top was delectable, as were the California rolls and other sushi standards. It was when we got into the nigiri that the quality severely dropped. The octopus was way too chewy; the salmon was fresh, but sorely lacking the high-grade buttery flavor.

A nice touch at Fune Ya normally missing from sushi boat establishments, though, was having the makings of a full meal via nonsushi items: appetizers (such as edamame) and dessert. The dessert was deep-fried tempura banana drizzled with sweet strawberry sauce. It was incredible. I am ashamed to say that my friend and I grabbed four plates, all of which were newly fried — warm, mushy banana in a crunchy, still-sizzling cocoon.

If you find yourself in the Inner Richmond (hopefully, you’ve taken the bus or ridden your bike), stop by Fune Ya. The cheapie promotion will last a few more months.

CHEAP EATS It’s a swirly, soupy thing, life, and I would like to be less dizzy in it but there’s this furiously pointless Ping-Pong game, nonstop, between my head and my gut. Fortunately, I’m a fan of the sport. And of spin, and slams.

Cousin Choo-Choo Train says I am never quite satisfied unless my dinner guests go home a little nervous, on top of everything else. And it’s true that I like to err on the side of salmonella, that I have no respect whatsoever for trichinosis, and that E. coli could be the latest Internet gadgetry for all I care. Still, no one has ever puked because of my cooking.

And if that ain’t a claim to fame … if I’m misclaiming itif I just don’t know — then please tell me so’s I can change my ways. I don’t mean to make anyone sick, just nervous. Just a little bit nervous, like, hmm, I wonder if I might wind up in the emergency room. But then you don’t. Like that.

A lot of people don’t like to eat with me. In many cases their reasons are valid, like they’re vegetarian, or don’t know me. Other people keep coming back, keep going home nervous, and keep coming back.

This is called a sense of adventure. I know you have one, dear reader, or you wouldn’t be reading Cheap Eats. You’d be hoping your parachute opens, or surfing where sharks are — something really really boring.

Speaking of boring, one of my oldest, meat-eatingest friends wrote to remind me, after I got soft a couple columns ago and accidentally wrote about a one-year-old client of mine who I love, and who loves flowers, that "there’s only one thing more boring than listening to cat-loving freaks talk about their freakin’ cats … "

The ellipses are his. I’m pretty sure he didn’t mean chickens, though, because I’ve been writing about chickens ever since I was a teenager, no lie, and we’ve been in writing workshops and bands together. Surely he’d have said something before now, like, "Whoa! Chickens are boring."

Besides which it just ain’t true. So he must have meant either babies or flowers. Probably both. Together. Cute little flower-loving babies. Boring — unless they’re yours (or your client) — according to people.

So, OK, so how am I going to make it up to my Cheap readership, this un-farmerly lapse of coolness? Why, it’s almost too easy! By treating you all to something so freakin’ fascinating, so exciting, so universally bacon that even the most jaded cynic will have to turn his NASCAR cap around afterward, read it again, shake his head, and go, "Whoa! Chickens are boring, compared to this."

The subject of which I speak, of course, is My First Mammogram. I thought I was going to say Food Poisoning. But everything changed when I went to the mailbox just now and there was a letter from the medics re: my March 3 breast imaging examination:

Blah blah blah, there’s something in there, yadee-yada, they believe it’s benign, but…. And these ellipses are mine because my brain by now was awhirl with horror and general aghastness at the thought that two weeks had passed since My First Mammogram without me writing about it!

Well: Everyone said it hurts like hell, especially for small-breasted women. They described mean-fingered, banjo-faced technicians leveraging practical white nursing shoes into your sternum, grabbing one nipple in both hands and yanking and flattening you out like pie crust, in some cases using marble rolling pins to coerce you into the picture.

"Are you currently pregnant?" my mammogrammer asked.

It was the kindest thing anyone ever said to me and I told her so, then realized that she probably had to ask, by law, even if you had a mustache. In any case, she was a dear, and it didn’t hurt one bit. I like pie.

And, no, I ain’t afraid of no probably benign notes in the mail. I know just what it was they saw in there: a ping-pong ball. I’m game. Next time they look, I know, it will be exactly the same size, only in a whole different place.

My new favorite restaurant is Roadside BBQ on Geary in the Richmond. Sockywonk’s been barking it up for a long time so I finally grabbed her and shook her and made her take me there. And pay. What I like, besides sweet tea, tangy no-mayo slaw, and great fries, is that it uses apple wood for smoke, in addition to the more common hickory and mesquite. Apple smoke is my favorite kind of smoke. Smoked chicken sandwich with avocado and cilantro, and you can get your ‘cue in a salad, which is something else I love.

Resistance is futile — or is it?

It was a time without precedent in American history. The commander-in-chief voiced his intention to take the country to war — a voluntary, preemptive war with no clear catalyst, no faraway invasion or Pearl Harbor or sinking of the Maine and millions of people shouted their opposition. With plenty of time to avert war, the protesters warned the invasion would be a costly disaster.

They were right. And it didn’t matter.

The war in Iraq was a test of our democratic ideals. It was a test that this country failed, a failure that has been felt by the people of the United States, Iraq, and elsewhere for the last five years. For many, the refusal of the US government to heed the demands of its citizens left them disillusioned and disempowered.

But others say it sparked a political change that woke up an apathetic citizenry, pulled the Democratic Party back to the left, and may have averted war with Iran.

It’s certainly arguable that the presidential campaign of Barack Obama owes its energy and success in part to the antiwar movement — and if Obama wins, he will be the first president in a long time who took office thanks to the support of a strong grassroots progressive movement.

Nowhere was the clash of people power and government will more acute than on the streets of San Francisco, where a series of massive marches, some drawing nearly 100,000 people, filled the streets prior to the invasion of Iraq on March 19, 2003. The onset of war led protesters to effectively shut down the city, resulting in about 2,300 arrests and millions of dollars in costs to the city.

President George W. Bush dismissed the protests, of course, but he wasn’t the only one. Political leaders such as Rep. Nancy Pelosi, then-Mayor Willie Brown and soon-to-be Mayor Gavin Newsom (who didn’t attend any of the marches, unlike progressives on the Board of Supervisors) condemned the peace movement for hurting an innocent city. But with the “battle for San Francisco” making international news, the protesters were more concerned with the global audience.

A month earlier, on the weekend of Feb. 15 and 16, there were coordinated protests against the impending war in about 800 cities around the world, drawing around 10 million people. The peace march in Rome included about 3 million people, earning a listing in the Guinness Book of World Records as the largest anti-war rally in history. People have never made such a loud and clear statement against an incipient war.

Beyond the numbers, the antiwar movement was also right. On every major issue and prediction, the messages from the street proved correct while those from the White House were wrong. The US wasn’t welcomed as liberators. There were no weapons of mass destruction. Iraq after the invasion isn’t a stable democracy or shining beacon to anyone but the new generation of jihadis Bush created.

We can blame a hard-headed president, ineffectual opposition party, failure of the national media, or the national climate of fear following Sept. 11. But rather than refighting that lost battle, now is the time to gain perspective on the events of five years ago and determine what it means for democracy and the post-Bush national agenda.

 

TO THE STREETS

There were two main umbrella groups organizing protests before the war: Direct Action to Stop the War (DASW) and International ANSWER (Act Now to Stop War and End Racism). ANSWER has remained active and DASW has recently been reconstituted for the fifth anniversary of the war, using direct action in San Francisco as well as other urban centers and outposts like Chevron’s refinery in Richmond, which has reportedly been processing Iraqi oil.

“With the fifth anniversary coming up, we’re going back to direct action on the streets,” said Henry Norr of DASW. “But I don’t have any illusions that it’s going to be like it was five years ago.”

The maddening march to an ill-advised war created a political dynamic in which a broad cross-section of Americans was willing to hit the streets.

“We had a wonderfully diverse group of people, from soccer moms to anarchists,” said Mary Bull, who cofounded DASW, a collective of various affinity groups and concerned individuals formed in October of 2002 as Bush started beating the drums of war.

It was a group fiercely determined to prevent the war — and really believed that was possible. In fact, Bull recalls how she and other members of the group burst out crying at one meeting when a key activist said the war was going to happen.

Richard Becker, who cofounded ANSWER and serves as its West Coast coordinator, said that in the summer of 2002, “we came to the conclusion that [the war] was going to happen.” The group called its first big protest for Sept. 15, 2002, and another one two weeks later. But the movement really exploded on Oct. 26 when almost 100,000 people took to Market Street, much of it a spontaneous popular uprising.

“We were overwhelmed,” Becker said. “We were in a perpetual state of mobilization to keep up with what was going on. But then it didn’t stop the war.”

Did he think they could?

“I think a lot of people thought maybe it was possible to stop it. And we thought maybe it was possible to stop it,” Becker said.

The high point, according to Becker and Norr, was Feb. 17, 2003, when the New York Times ran a front page analysis piece entitled “A new power in the streets” that claimed “the huge anti-war demonstrations around the world this weekend are reminders that there may still be two superpowers on the planet: the United States and world public opinion.” But then Colin Powell went to the United Nations to argue for the invasion, and the Democrats in Congress did nothing, and it became clear war was coming.

Norr stayed out there protesting, being arrested several times and even shot in the leg by Oakland police with a rubber bullet during a protest at the Oakland docks. And he thinks some good came from the experience.

“The lesson for people is the political and economic elites are committed to preserving and extending empire. And they basically say as much in their own writing,” Norr said. “Wars are not anomalies.”

Despite being a frustrating and depressing exercise, most saw benefits to the failed movement. “People got an incredible education about how the system really worked,” Becker said. “Building a movement is mostly about a series of setbacks.”

Medea Benjamin, cofounder of both Global Exchange and CodePink and fixture of the anti-establishment peace movement for years, was upbeat about the protests. “We did our job as citizens. We did what we were supposed to do: organize, get people to take action, get people onto the streets,” she said. “We did everything we could think of.

“What you take from it is we don’t have a very well-developed democracy because the people spoke and the government didn’t listen.”

FACING ARREST

The collective action of five years ago starts with a series of personal stories — tens of thousands of them — so let me briefly begin with mine.

My arrival in San Francisco was closely tied to the march to war. I was living in Sacramento and working as the news editor of the Sacramento News & Review when Bush began his saber rattling against Saddam Hussein, but by the end of 2002 I had a falling out with my boss and found myself jobless.

Like most Northern Californians who opposed the war, I came to San Francisco on Jan. 18 to make my voice heard and experienced a bit of serendipity on my way to Justin Herman Plaza: while reading the Guardian on Muni, I saw their advertisement for a city editor, a job that was ideal for me at a paper I’ve always loved. Needless to say, it was a great day, empowering and full of possibilities.

Less than two months later I was on the job, and on the second week of that job I was back on the turbulent streets of San Francisco, part of a Guardian team covering the eruption of this city on the first full day of war. When I stepped off the cable car just after 7 a.m., people were streaming up Market Street and I joined them.

When a large group stopped at the intersection of Market and Beale, I stopped too, taking notes and bearing witness to this historic, exciting event. I had a press pass issued by the California Highway Patrol that allowed me to cross police lines, so when police in riot gear surrounded us and threatened arrest, I held my ground with 100 or so protesters.

After interviewing about a dozen people about why they were there and that they hoped to accomplish (see “On the bus: Journalists, lawyers, four-year-olds — the cops were ready to bust anyone Thursday morning“), I was arrested with the others and taken to a makeshift jail and processing center at Pier 27 (no charges were filed in my case, and charges against all of the 2,300 people arrested here in those first few days of the war were later dropped).

I recently tracked down a few of the people who appeared in my article, including Daphne and Ross Miller, who were at the center of the most interesting drama to play out during our standoff with the police. She’s a family practice physician, he’s an architect, and they live in Diamond Heights with their two children, Emet, who is almost 9, and Arlen, 12, who was away on vacation when the war began.

“We were genuinely shocked that the war started,” Ross told me. “We were at some of the earlier protests and really thought there was no way [Bush] could do it.”

They woke up March 20, 2003, to news that the war had begun and immediately walked to the BART station with Emet and rode to the Embarcadero station, not really planning for the day ahead but just knowing that they had to make themselves heard.

“We were pissed as hell. I don’t think I’ve ever been so angry in my life,” Daphne said.

They quickly came up with a plan. “We basically decided that if anyone was going to be arrested, it was going to be Ross and I’d stay with Emet. But it didn’t end up that way and I ended up in the arrest circle.”

Daphne had their house keys and threw them over the police line to Ross at one point. A photographer in the circle had gotten shots of a man named Roman Fliegel being roughed up by police as they pulled him off his bicycle, which was towing a trailer with a sound system, and decided to throw his backpack with camera gear out as well. When Ross — who had four-year-old Emet on his shoulders — caught it and refused police orders to give it to them, police grabbed Emet and roughly arrested Ross, leaving a gash on his forehead.

“Rage surged through the crowd, and it seemed as if things might get ugly, but the police kept a tight lid on the situation, using their clubs to shove back protesters who had moved forward,” I wrote at the time.

Emet was delivered into the circle with Daphne as the arrests continued, many quite rough. “At that point, as a mom, I had to exercise the most restraint ever,” said Daphne, who was angry about the situation but fearful about what she was exposing her son to. “Please, don’t let any violence happen here,” she pleaded with the crowd. Eventually, commanders on the scene let the mother and child go.

“The officer who let me go said that if he saw me again out there, he would call Child Protective Services on me,” Daphne said. But two days later, still brimming with outrage at her country’s actions, she ditched a downtown medical conference to rejoin the street protests, this time solo.

The couple say they’ve lost friendships over the war and have become more engaged with politics, coming to believe that Bush and the neocons are malevolent figures who knew how badly the war would go and did it anyway to establish a large, permanent military base in Iraq.

“Since that day, we’ve been far more active,” Ross said. “We realized you can’t just trust the system. You have to push.”

But that determination was mixed with feelings of disempowerment and depression. They attended some of the protests that following year, but the couple — like most people — just stopped going at some point because they seemed so futile.

“There was a horrible sense of resignation and a genuine depression that followed,” Ross told me.

The nadir was when Bush was reelected and they considered leaving the country. But then, Ross said, “we decided we’re not just going to run away and we’re not going to accept this.” Looking back, even with the scare over Emet, they express no regrets.

“It was the right thing to do because it was the wrong war to have. I’d do it again and again and again if I had to,” Ross said

They’re guardedly hopeful that Barack Obama could begin to turn things around if he’s elected. “I think the right president can at least start to dismantle this,” Daphne said. “I think thousands of people marching in the streets is something he would listen to.”

WITNESS TO HISTORY

Covering the peace movement in those early days was a heady experience, like reporting on a revolutionary uprising or working in a foreign country where the people are organized and active enough to be able to shut down society and brave enough to risk bodily injury for their beliefs.

I was at the founding meeting of CodePink — which became the most effective group at personally confronting the warmongers and keeping the war in the public eye — one evening at Muddy Waters in the Mission District shortly after the war started.

Looking back, Benjamin rattled off a long list of the alliances the group built — with labor, churches, businesses, and a wide array of social movements — and creative actions intended to build and demonstrate popular support for ending the war.

“We’ve done so many things and what did we get? We got a surge,” she said. “It shows the crisis in our democracy, the crisis of the two-party system, the crisis of a dysfunctional opposition party.”

Yet she said the peace movement has been remarkably successful in convincing the public that the war was a mistake and that it’s time for the troops to come home, even if the Democrats have been slow to respond to that shift.

“The progress we’ve made is turning around public opinion and that’s going to play a big role in the upcoming elections,” she said. For Norr, the role of the news media is a particular sore spot. He was a technology reporter for the San Francisco Chronicle who called in sick on the first full day of war and was arrested on Market Street with his wife and daughter, resulting in suspension by editor Phil Bronstein for his actions.

I wrote several stories on the issue, which culminated in Norr being fired and Bronstein unilaterally banning Chron employees from peace protests. I even borrowed CodePink’s guerilla tactics when Bronstein repeatedly refused to return my calls or address why he had singled out antiwar protesters for uniquely punitive treatment. I confronted him during a speech he gave at the Commonwealth Club (see “Lies and half-truths,” 5/7/03). That was the tenor of the times: we were all tired of being lied to and we decided to push back.

Norr was particularly frustrated with his own paper’s reporting of the war and started sending articles by the foreign press to his paper’s news desk, trying to wake his colleagues up to the pro-war propaganda being passed off as journalism in this country.

He was also disappointed with the country and with the Chronicle — both the management and his fellow reporters, who did little to support him — but the experience caused him to return to his roots as a progressive activist.

“The war and losing the job and everything brought an abrupt end to my consumerist phase and dumped me back into the world of being an activist,” said Norr, who serves on the KPFA 94.1 FM local station board and has made three recent trips to the Palestinian territories while working with the International Solidarity Movement.

Benjamin said Americans shouldn’t expect the next president to end the war — not without lots of pressure from a renewed and vocal peace movement. “This is the time to set the stage for the post-Bush agenda,” Benjamin said. “Don’t put your hopes in Barack Obama in getting us out of Iraq. Put your hopes in the people.”

THE AFTERMATH

The San Francisco Police Department, which spent more than $2 million on overtime costs responding to peace protests between March 15 and April 16, 2003, generally behaved with restraint and professionalism, but there were several exceptions.

The most costly and disturbing incident came when Officer Anthony Nelson began aggressively swinging his long riot baton at protesters, badly shattering the arm of peaceful protester Linda K. Vaccarezza, who suffered a permanent disability in her career as a court reporter.

Nelson’s incident report falsely stated that Vaccarezza had threatened him with a sign attached to a solid pole, but video of the incident later clearly showed there was no pole and that she was retreating when he teed off on her (see “The home front,” 05/19/04).

Vaccarezza received an $835,000 settlement from the city in November of 2004. On Oct. 5, 2005, two and a half years after the incident, SFPD fired Nelson for lying about what happened that day, and the City Attorney’s Office has been successfully fighting Nelson’s appeals in court ever since, putting in more than $100,000 in attorney time and costs into the Nelson and Vaccarezza cases.

The other significant ongoing litigation from the antiwar protests involved Mary Bull, who was arrested during an early protest for pouring fake blood in front of the entrance to Chevron’s San Francisco office before being allegedly strip searched and left naked in her San Francisco Jail cell for 36 hours.

Ironically, Bull was among those who brought a successful class action lawsuit against Sacramento County after she and others protesting a logging plan were strip searched, setting a precedent and led most counties to reform their strip-search policies. She used her share of the $15 million judgment to buy an organic permaculture farm in Sebastopol.

Her San Francisco case, in which Bull won a multimillion-dollar judgment, is still under appeal and now in mediation. Bull said the protests five years ago did make a difference, something she tells those who fret about its apparent failure. “I tell them to look at what issues the candidates are talking about now and I thank them for protesting then.”

“Even though we had millions throughout the world, we were sort of blocked, but now we’re regaining that momentum,” Melodie Barclay, a massage therapist who was also arrested with me on the first day of the war, told me recently. “We can’t judge it by the fact that we didn’t get the momentum we wanted.”

Norr started his antiwar activism working with Students for a Democratic Society in Boston, protesting the Vietnam War, which he said shares many similarities with the current situation, for good or for ill. He said that people tend to forget that while the protests then were huge and helped end the war, the movement did wane after Nixon ended the draft and substituted massive aerial bombardment for boots on the ground.

“The protests dropped off considerably,” he said. “A lot of the things that drove people to take risks in the late ’60s had faded by the early ’70s.”

He thinks the current administration learned a lesson from those days: it’s easier to maintain a war effort if the average citizen isn’t affected.

But there are other factors as well keeping a lid on the antiwar outrage.

“The culture has changed too. Young people are oversaddled with debt. People in schools seem to be docile. The culture as a whole seems to be more individualist and consumerist,” Norr said.

Yet some young people have woken up and many of them are funneling their energies into a peace group that was formed in the summer of 2005: World Can’t Wait, as in: the world can’t wait for the end of Bush’s second term before we change our direction and leadership.

“We don’t just want them gone, we need to repudiate their program,” said Giovanni Jackson, a 26-year-old WCW student organizer. “If we’re going to change anything, we need the youth.”

Jackson was at WCW’s founding convention in New York City, which came just as New Orleans was being flooded and then essentially abandoned by the federal government.

“When [Kerry] lost, people felt demoralized and World Can’t Wait kind of stepped into that situation,” Jackson said. “There was a lot of demoralization in the antiwar movement at that time.”

The group organized protests and student walkouts on Nov. 2, 2005.

“Everyone has their moments of doubt,” he said, “but I’m motivated by the crimes we see everyday.”

 

THE LESSONS

One of the biggest barriers to galvanizing people and turning the fifth anniversary of the war into something that might make a difference is the presidential election, which is diverting the energy of many potential protesters — and at the same time, offering some hope that a new president may lead to peace.

After all, every single one of the Democratic presidential candidates has promised to withdraw troops from Iraq, with varying timelines and numbers of US personnel left behind. And with enough encouragement, they might be willing to help change the status quo.

Many of the activists who volunteered their time and money to help move the Obama campaign into its front-runner position came out of the antiwar movement, and Obama’s strong stand against the war has been a key factor in his popularity.

Becker and some other activists don’t have much faith that a change in presidents will change the course in Iraq, although he agrees that much of the energy now surrounding Barack Obama derives directly from the antiwar movement.

“There’s been a huge upsurge of hope for Obama and that he might bring about the kind of change we need,” Bull said, adding that she doesn’t share that hope, believing the only path to peace is to pressure Obama and other leaders to commit to more progressive positions.

Norr said, “On one level, people have illusions about the power of peaceful protests. People believe in democracy, as well they should. We feel like the rulers should be paying attention to public opinion.

“It’s a remarkable story how broadly and quickly the American people have turned against the war. Public opinion was certainly ahead of the Democrats.”

And people will only grow more disenchanted with Iraq and its multitude of costs. “The people here are paying for this war, and everyday we have new stories about health clinics being shut down,” Becker said.

Becker was amazed last March as massive demonstrations for immigrant rights seemed to explode out of nowhere. “We think there will be more things like that,” he said.

Because after five years of organizing communities to resist the military-industrial complex’s plans, Becker thinks there’s been some visible progress.

“There isn’t a town or hamlet in the US that doesn’t have activism going on, but you wouldn’t know it from the corporate media,” Becker said. “It’s a mistake for people to feel discouraged.”

CHEAP EATS I see flowers very differently. Not because I’m a woman now, or a softy, or insane, or even a chicken farmer. It’s a kid thing. I learned it from little Clara de la Cooter, who bonked into the world a year ago and very quickly became my new favorite person in it.

Probably not a lot of people get to babysit their ex’s kids. So I’m lucky in that sense, and so is Clara. She’s a passionate eater — I daresay a budding foodie. Her favorite food so far is eggs. I’m just saying …

It’s not hard to imagine who her favorite auntie will be, I’m saying.

Today I saw an ad on the side of a truck that said, "Just the freshest eggs you will ever eat." I forget the brand, but if its slogan is true, then I highly recommend it. Its eggs will be sold not by the carton but by the chicken. Yo, I’ve held warm ones in my hands on cold days between the nest and the skillet. I’ve had to postpone lunch until almost dinnertime because somebody was all stopped up.

And the boys who I’ve dated have not tended to bring flowers. But that’s OK, because most of them never knew they were dating me. I like to think of Clara de la Cooter’s first date. Some awkward, googly kid hands her a flower and she laughs.

"What?" they say, offended.

But if they knew her now, they would know better. The girl just cracks up at the sight of flowers. That’s all. For some reason they are the funniest thing in the world to her. They’re hilarious. She points and giggles, and she laughs her head off. And I think that’s beautiful. More beautiful than I used to think flowers were.

I’m inspired. I want to laugh at flowers too, and I think there’s a chance I might learn to. Yesterday we took two walks together. It’s spring. It’s Berkeley. I held her in bushes and she kicked her legs and squealed with pleasure, rattling the leaves and branches. I pushed her stroller right up into pink ones, purple ones, white ones, yellow ones, and she pointed and laughed and touched and tugged. That she also tried to eat them goes without saying, don’t you think?

Under a lemon tree I wheelied the stroller back so she could look straight up into it. The tree was loaded, and she lost it. She busted a gut. All that yellow, it was early Woody Allen to her. If she hadn’t been so strapped in, she’d have been rolling on the sidewalk.

I want this. I want one. And that alternative-weekly groan you’re hearing is all my old friends, because they know how I used to be. And people tend to expect you to stay the same. Especially those who love you most.

Which reminds me that one day Clara will not be so tickled by flowers, or not in the same way. Maybe she’ll have allergies. I had a fantasy, under the lemon tree with her, that I would live to be 84, and that she would ask me, hopefully over dinner, what she was like when she was one.

Like I started asking my own parents, and at least one of my aunts, a couple years ago. They didn’t seem to know much, maybe because I was 1 of 11. Or they forgot. Which … I don’t have the world’s best memory myself. Already. What I will have is an excessively creased and yellow newspaper clipping in my apron pocket, where I’ve been keeping it for 40 years, just in case. "You found flowers very funny," it will say. And: "We laughed till we cried."

Making limeade out of lemons is my motto in life. This was someone else’s tree, of course, but I picked a small, hard one and put it in Clara’s little hand, unwashed, let her gum and suck it. And a couple of sidewalk squares later I saw, and picked, one tiny wild strawberry, the size of a pea. This I put in her other hand, knowing she’d eat it. And that it might have been sprayed, or peed on by a dog.

My new favorite restaurant is one of my old favorite restaurants, but I never told you. It’s the 55-year-old Cinderella Russian Bakery in the Richmond, where I refueled with my soccer buds recently and dripped sweat and blood (from my nose) onto stuffed cabbages, garlicky potatoes, homemade bread, and dill in general. Wow! I think my mates were looking for more like, you know, breakfast, but for my money this is just the thing.

Of the city’s many village centers, I have always had a special fondness for the Inner Richmond enclave along Balboa, from Arguello to Eighth Avenue or so. Here you find Russian bakeries nestled across the street from sushi bars, with a Korean barbecue at one corner, a Chinese joint at the next, and a chic Cal-Med spot a few steps beyond the traffic light. Add a butcher shop, a nursery school, and a cleaners, and you have a self-sustaining little world. It’s like a less-trafficked Clement Street.

The backwater charm has persisted for years, despite the occasional incursions of upscaleness: Katia’s Russian Tea room, with its immaculately starched tablecloths, and, of more recent vintage, the Richmond, which opened a few years ago in the old Jakarta space. The latest spit-and-polish entrant, Namu, isn’t as conspicuous as either of those two restaurants; it opened about a year ago in a midblock storefront, and you could easily walk right by it if you weren’t paying attention.

At least you could in the middle of the day. By night, Namu attracts the young the way a lantern attracts moths on a summer evening; they gather in clusters on either side of the door and along the curb, dressed in night shades of blue, gray, and black, talking on cell phones while waiting for a table to open up or the rest of their party to appear. If you were rushing along the sidewalk, you could probably pick your way past without too much fancy footwork, but you’d notice the crowd, certainly, and wonder what was up.

Part of what is up is certainly chef Dennis Lee’s cooking. (Lee owns the place with his brothers, David and Daniel.) Although Namu’s menu includes elements of both Japanese and fusion cooking, its most striking quality is its elegant recasting of Korean themes. It’s not quite a Korean bistro, but it’s more than a step in that direction and away from the traditional Korean barbecue, an honorable example of which stands at the corner.

Namu does offer that well-known Korean staple, kimchee (cabbage pickled with garlic and red chiles), and it’s just about indistinguishable from the corner barbecue’s: both offer excellent, sour fire. But at Namu the kimchee is served as part of a banchan plate (the first is complimentary, after that $4), in the company of, say, surprisingly rich sautéed chives and coils of pickled carrot, all presented on a museum-of-modern-art dish that looks like a flattened candelabra. There is a sense of stylish balance in both presentation and flavor that announces the kitchen’s sophistication.

You could satisfy yourself entirely with Japanese items, if you were so inclined, and you might even be able to convince yourself that you were at a sushi bar. Although there’s no sushi on the menu, the restaurant’s look is agleam with dark minimalism, including the unframed urban-industrial photographs hung on the walls as if at a hip gallery. Anyway, tataki — lightly seared tabs of fish — is almost like sushi, and Namu’s version ($10), with albacore tuna, is cleverly enhanced by a drizzle of Thai chili ponzu. Seaweed salad is also a sushi bar standard; here it’s called ocean salad ($8) and is made from a jumble of red, green, and wakame seaweed and looks like leftover Christmas wrapping. Nice touches: halved cherry tomatoes beneath the seaweed, and ume vinaigrette (ume is a pickled Asian plum) to give the salad fruitiness that isn’t quite sweet.

Pan-seared dumplings (a.k.a. pot stickers) are a commonplace throughout east Asia. Here ($9) they’re filled with slivered shiitake mushrooms and served in a shallow bowl with yet more shiitake slivers and a dashi broth reduced to dark intensity. (Dashi is one of the basics of Japanese cooking and is a stock made from kelp and dried skipjack.) Fresh rolls are also an east Asian commonplace, but Namu’s version ($6) feature a cross-cultural twist: chunks of grilled skirt steak, for a hint of the American southwest and, simultaneously, Korea. Just as unexpected is the mung bean cake ($6), and if you shy away from mung beans as the principal ingredient of indifferent desserts, you’ll be surprised here by the resemblance to crispy polenta triangles, suitable for dipping in ponzu sauce. And there is an explicitly Italian touch to the buckwheat noodles ($9.50); they’re tossed with shiitake mushrooms but also pesto (from Thai basil!), pine nuts, and garlic before getting a good sprinkling of grated Parmesan cheese.

We didn’t particularly respond to the broccolini ($7), which wasn’t bad but wasn’t special despite embellishments of yuzu ponzu and fried garlic. It seemed too much like ordinary steamed broccoli. But we did respond to the prawns ($9), which had been glazed with den jang (a Korean fermented bean paste similar to miso) and grilled in pairs on skewers.

Too much culinary globe-trotting? The hamburger ($9), then, is restful in a juicy, tasty, villagy way, with a first-rate bun and good fries that would be just a bit better if more svelte, more in the frites line. Of course, even B+ fries tend to get gobbled up, even by those who mean to save some room for dessert. Namu’s desserts are well above the ordinary: a chocolate brioche bread pudding ($7) for instance, napped with raspberry sauce (is any dish with brioche disappointing? I say no), and a puddinglike crème brûlée ($7) lifted from the mundane by little butter cookies flavored with our friend ume, the distinctive Japanese preserved plum last observed in the seaweed salad vinaigrette. Some plums certainly get around.

My ex-girlfriend hipped me to TopR, short for Top Ramen, around 2003. We were driving in her car, and she cracked open the newly released Burning the Candle at Both Ends (Earthlings/DWA) and slid it into the dash. I’d like to say it changed my life, but to be honest, I can’t remember it. I do remember that she described TopR as this homeless, couch-surfing rapper who’d slept on her previous boyfriend’s couch. It was classic case of his reputation and lifestyle preceding his music.

Later I met TopR — or Topper Holiday, as he’s ceased using his first name — at 111 Minna Gallery, where I still work a side gig as a doorman. Throughout my years there he’s been a semiregular fixture, posted at the end of the bar, skeezing free drinks. He’s well loved but has this Dennis the Menace air surrounding him, like, "Oh, Topper’s here. Here comes trouble." One night in Minna alley, I remember him — a big, bescruffed white dude in a fitted New Era cap, somewhat rotund and more than a little faded — striking up a conversation with some bland, buttoned-down types, telling them he was a rapper and following up with a drunken freestyle. I came away feeling that it was a little sad, like he was busking in a BART station, trying to impress the squares.

"Fuck being glamorous — I’m cantankerous." So goes the first line on "Frankenstein’s Topster," the opener off his latest, fifth album, Marathon of Shame (Gurp City). It was playing when I walked into Dalva on 16th Street to say hello to my friend Toph One and reintroduce myself to TopR. And quite a reintroduction it was: even before Top starts rapping, the track is a fucking winner, anchored by a sample of Black Sabbath’s "A National Acrobat," the driving guitar riff married to an überfunky drumbeat by producer Dick Nasty.

A good hip-hop album is like a good comedy record: the shit’s got to be so sharp that you want to listen to it more than once, want to scan back on the CD and point out lines to your friends who are riding with you. In Top’s case it’s an apt comparison since he’s influenced by stand-up comedians as much as by other rappers and samples Sam Kinison and Bill Hicks on his previous disc, Cheap Laughs for Dead Comedians (Gurp City, 2006). Marathon is packed with lines that’ll make other rappers wish they’d written them, from favorite one-liners like "Puttin’ squares in their place like Tetris" to heartfelt couplets such as "I don’t want to fit into this banality factory / Where together we can all make profit from tragedy."

It stands to reason that TopR can come up with witty rhymes: he’s been rapping since he was 12. Now 30, he gained his rep as a battle rapper at parties and clubs. "From ’93 until 2000 all I did was battle," he says over a pint at the Richmond District’s 540 Club. "I didn’t record music. I didn’t put out anything. I just made a reputation for myself through battling. If I was putting out albums in ’95, ’96, I might’ve been an actual artist like Living Legends, Atmosphere, and Hieroglyphics. You can only be a battle rapper for so long. After a while there’s not very much creative outlet for it. You can only make fun of someone for so long before you actually want to express your real problems and your real feelings about life. And you do that through writing songs."

In a time when your average radio rap track has more advertisements for sneakers and pricey booze than a copy of GQ, TopR represents a more compelling side of the hip-hop spectrum: the storied tradition of rapper as traveling salesman, hawking CDs "out the trunk," or in his case, out the messenger bag, since, as he says on "Siren Song," "the Muni is my chariot." And while he often calls himself out as lazy in his songs, TopR’s tale is a cross between the 1984 runaway-punk movie Suburbia and the classic Horatio Alger story.

A self-described "troubled kid," TopR left his parents’ home in Santa Cruz at 15, living in squats and hitchhiking to San Francisco to hit open mics and do graffiti. He was arrested for vandalism, went back home, and left again, sleeping on couches if he was lucky and outside if he wasn’t. He attributes his notoriety in the bar scene to necessity: "The fact that I was homeless — I had to be in bars every goddamned night, looking for places to stay. I had nothing better to do."

Slumming, bumming, and battling eventually led to some Greyhound cross-country tours and a devoted following of party kids and misfits, unhappy with the status quo and, like him, struggling to get by. There’s no shortage of the usual hip-hop bravado on Marathon: "I’m a piss artist who spits darkness at bitch targets," TopR raps on "Siren Song," "<0x2009>’cause the music that’s honest is the music that hits hardest." True, but the track isn’t merely empty braggadocio: it’s nothing less than an existentialist crisis with a beat, one rapper’s The Sickness unto Death, asking the eternal questions of the artist and, ultimately, everyone who’s been "up against it."

And while it’s the struggle — and the willingness to cop to it — that makes Marathon so compelling, it seems TopR might finally be on the bus toward Figuring It All Out. On a tour in 2005 he met his fiancée, Kelly-Anne, perhaps the muse of "Siren’s Song," bartending at one of his shows in Asheville, NC. He stayed in the South for more than a year before getting an apartment, with a couch and a bed, in San Francisco’s Sunset District. "I came up as ‘the homeless kid who slept on couches,’<0x2009>" he explains. "But I was good at graffiti young, and I was a good rapper. I got away with a lot of stuff that some punk little kid wouldn’t because people respected me for my talents or whatever. But I’ve mellowed out." Here Top takes a contemplative pull on his pint. "I mean, I’m fuckin’ 30. I’ve got a dog now."

I’m going to do my part to go tell it on the mountain, to put this disc on when we’re cruising down the street, to make sure you hear the hilarious lines and crucial cuts. But on the other hand, one reason why it’s so good is because you ran into him in the bar and bought a disc so he could have beer money. TopR may have reached escape velocity from his day job, but he’s still orbiting the homelessness of his recent past. The line that sums up TopR for me is from "I’m on One" on Cheap Laughs: "It doesn’t take a genius to see that we’re livin’ stressful / The secret to my success is that I’m unsuccessful." It might be better for him if he got the juice to leave orbit altogether and rocket into the outer galaxies of hip-hop superstardom, but would it be better for his music if he weren’t "livin’ stressful?" Living hand to mouth myself, I’m heartened to see someone who keeps grindin’, who tries to live a creative life in the face of SF-size rent, the approaching years, and a music industry that may never give a shit. To quote TopR’s MySpace page, "Even when nothing goes right I still prevail."

SPORTS: The return of C-Web is a bad idea

Thomas Wolfe may have been exaggerating when he wrote “You Can’t Go Home Again.” But in the case of basketball player Chris Webber that phrase should be taken as gospel.

Especially when it comes to a possible return to the Warriors, Webber’s initial NBA club. When Webber forced his way off the Warriors in the fall of 1994, he just didn’t leave the franchise and team’s dedicated fan base in the lurch. He dumped a gallon of gasoline on the shag carpet and lit a match.

But here we are more than a dozen years later and there is serious talk of a Warriors and Webber reunion. But before the Warriors make that move we implore Golden State to take Amy Winehouse’s advice and say “No, No, No.”

The current Warriors, with Baron Davis and Stephen Jackson leading a “shoot-and-ask-questions-later” barrage are currently the most entertaining and only winning pro sports team in Northern California. But today’s W’s still have a ways to go in matching the excitement level generated by the Warriors clubs of the late 1980s and early 1990s.

Led by fish-tie-wearing Coach Don Nelson in his first tenure as Warriors coach, those Warriors reinvented NBA basketball in the Bay Area. Led by Timmy Hardaway, Mitch Richmond and Chris Mullin (AKA Run-TMC), those Warriors clubs put on awesome scoring displays every time they took the hardwood, selling out the Coliseum Arena on a nightly basis and winning a couple of league scoring titles in the process.

Warrior’s fans ate it up like popcorn, or more accurately free pizza, which they won every time Golden State scored 120 or points in a game, which was frequently.

Despite a high entertainment value, the Warriors of those days lacked the presence of a great big man to move them deep into the playoffs. But that all changed in 1993 when the Warriors managed to draft Webber, the collegiate superstar who led Michigan to the NCAA championship game in ’93.

With its 75th season, which starts Jan. 29, the San Francisco Ballet — the oldest ballet company in the country — intends to show that the dance form is a thoroughly contemporary, international art.

With the exception of the lovely Giselle (created by Adolphe Adam in 1841), the entire season has been choreographed within the company’s lifetime. When it was created in 1938, Lew Christensen’s Filling Station was considered the first American ballet. Other season highlights will no doubt include the New Works Festival (April 22–May 6), with premieres by 10 choreographers in three different programs. On this anniversary, it’s worth recalling that there may be a historic reason why San Francisco ballet audiences have often embraced the new.

Carlos Carvajal, now co–artistic director of the San Francisco Ethnic Dance Festival, danced with the SFB from 1950 to ’55 and, after a stint in Europe, worked from 1964 to ’70 as its ballet master and associate choreographer. He remembers the period as one of crowded quarters on 18th Avenue in the Richmond District — there was a hunt for theaters in which to perform because the Opera House shared space with the San Francisco Symphony at the time, and the SFB often lost out. But it was also a period of dazzling vitality.

"It was a crazy, wonderful time, with such creative energy. Not just for the dancers, but musicians and designers as well," Carvajal recently recalled. Dancers regularly choreographed for the main season. His Totentanz, for instance, premiered at the SFB in 1967 and stayed in the rep until 1972. When Carvajal left the SFB, he brought the piece to his San Francisco Dance Spectrum, where it proved to be one of the company’s most popular works. The SFB functioned almost like a modern dance company whose members were simply expected to take up choreography sooner or later.

While the company was unemployed after its annual spring season, its summer workshops, called the "Ballet ’60s" series, offered creative outlets and some touring opportunities. "We used to take the wall down between two studios and converted one of them into a place for the audience. The other was the theater," Carvajal remembered. "Somebody suggested choreographing the Kama Sutra, so I took a look and figured I could do [it]." The same year, he choreographed Voyage Interdit: A Noh Play, for which he created a tape collage. The work’s second incarnation had a live rock band and a light show. "Remember," he said, chuckling, "those were the crazy ’60s, when anything went. We didn’t care about money; we only cared about dancing." And audiences, particularly younger ones, both in towns and on the road, flocked to see what was new — and what was this thing called ballet.

“Why not do something really special?”

DIY fever is raging right now, racing across bridges like a maddening epidemic here in the Bay. It’s so damn thick that I can feel it leeching onto the back of my throat and sticking there like the unpleasant stench of some urine-soaked thrash pad where 20-odd squatters, each with a dog, are hiding out. But times are tough, as the Bay Area underground music community discovered earlier this month when 21 Grand, the Oakland grassroots platform for experimental art and music, shuttered its doors. It was a shocking blow — proving, after the closures of Mission Records and Balazo 18 Art Gallery before it, that the outlook continues to be challenging when it comes to maintaining an all-ages performance space without the unfriendly rap on the window.

The members of Didimao — three San Francisco transplants from different parts of the globe — make up a minute fraction of those mourning the perhaps temporary loss of the East Bay arts hub. In fact, they seemed somewhat reluctant to talk about their two-year-old project, instead filling in the spaces left by my questions by glorifying the old Mission punk scene or changing the subject and plugging away at their favorite local band at the moment.

During our two-hour conversation at the Inner Richmond ice cream shop where bassist Matt Chandler works, the trio continuously stressed the impact outfits such as Dory Tourette and the Skirt Heads, Curse of the Birthmark, and TSA have had on Didimao. Guitarist-vocalist Sergey Yashenko must have name-dropped Stripmall Seizures — a group Chandler plays with — at least 15 times and at one point even proclaimed that the Seizures are the best band in the country.

As our discussion unfolded, however, at least one thing became pretty clear: Didimao simply aspire to share their music, which works an unconventional vein similar to that of their predecessors yet feels out of touch with the current Bay Area music scene. "Scenes get so specialized in this city. If you go to a noise show, it’ll be strictly noise. If you go to a free jazz show, it’s only free jazz," Chandler said. "There’s so much shit going on that it almost acts against itself. I come from a small town in Indiana, and all the people who make noise or who are in a weird rock band are forced to hang out together and influence each other. Here it seems like people who are into noise are into nothing else. And they’re fascist about it."

Noise — at maximum abrasiveness and volume — nonetheless happens to be the key ingredient in Didimao’s repertoire. On its self-titled debut on the Cococonk label, the group heavily recalls the Butthole Surfers at their most acid damaged, mixing cow-punk riffs with improvised moments of dark, tripped-out electronics and pummeling tumult. Yashenko’s guitar buzz-saws harshly with loose, Middle Eastern–inspired arrangements and feedbacked clatter, while his buried Slavic yodel sounds as animalistic as a howling dog. Chandler musters hasty, fuzz-prone bass lines to match the breakneck tempos of drummer Miguel Serra, and the two of them fluctuate from slam-dance explosiveness to free-rock noodlings to western rhythms and back again.

Serra clued me in that Didimao’s songwriting process is informed by both their limitations and how they’d like to sound. "I feel like a lot of our songs right now are dictated by what we don’t want to sound like as much as what we do want to sound like," he explained. "None of us are virtuosos by any means, so it’s kind of hard to have an idea of what you want to sound like and just pull it off.

"We come up with something and try and make it as acceptable to our standards as possible," Serra continued. "Recently, we’ve really wanted to be kickass, so on a lot of our new songs we’re, like, ‘How do we make this song kick more ass?’<0x2009>"

In addition to all of the ass kicking in the recording studio, Didimao have one other goal they would like to tackle in 2008, an ambition Yashenko returned to repeatedly throughout our chat.

"In the future, what we really want to be doing is playing mainly all-ages shows outdoors for free, because we all have jobs and don’t really need the money," he said. "In the end you probably end up doing all kinds of different shit, but after doing it so many times you want the shows to be this special event. So why not do something really special, you know? Like start doing shows in Ocean Beach at 3 a.m." *

Clay Oven

Two cheers, then, for Google, which recently rerouted its Noe Valley shuttle-bus lines so as to cause less air pollution and other distress in the heart of a neighborhood that has become, in effect, Googleberry RFD, the nesting habitat for those countless Google employees who spend their working days in the suburban wilds of the Peninsula. The child is father to the man, and the city is now the suburb, a dangling appendage to industry but no longer itself industrial. Just recreational.

During the last dot-com boom, in the late 1990s, a rise in both quality and quantity was noted in Bay Area restaurants serving Indian food. Software engineers and other tech types of Indian heritage were drawn here for work, and they expected — and got — an improvement in Indian restaurants, which previously were scarce and abysmal. The renaissance, or naissance, first took hold in the South Bay, whose environs were and are dotted with gigantic tech installations (including Google’s, in Mountain View), but now that everyone has moved to the city, enabled by shuttle buses with wi-fi and probably whirlpools, the city is getting better Indian restaurants too. Two more cheers.

Before the recent opening of Clay Oven, Noe Valley had no Indian restaurants at all, not a one, despite the neighborhood’s profound connection to Silicon Valley. An Indian restaurant in Noe Valley was arguably overdue — and not just because of software engineers and other Googloids either, but also because many of the rest of us marginal-Luddite types happen to like Indian food and its hit parade of spices. Of course, Dosa and Aslam’s Rasoi, each within a few steps of Valencia and 22nd streets, aren’t exactly light-years from Noe Valley, but there is something cozier about Clay Oven’s setting on outer Church, amid a quieter but flourishing restaurant row and Muni’s J trains rumbling past at odd intervals: a real convenience for those lucky enough to catch one.

If you believe addresses are portents, then you might think Clay Oven’s prospects are no better than mixed. The space was occupied most recently by a California-style bistro that never quite caught on, and before that by a Chinese restaurant that never quite caught on, and before that by a Burmese-inflected spot whose owners kept an old sofa and a dead television at the back of the dingy dining room. The Burmese food was pretty good, but eating there was like having dinner in a U-Store warehouse.

All of that dimness and debris has been cleared away. The old TV and sofa are long gone, and the kitchen has been separated from the stylishly low-key dining room by a new wall. Even the building’s faded facade has been remade; it’s now clad in red granite. If you didn’t know what used to be here, you would never guess.

The food is what many of us would probably consider standard-issue in Indian restaurants these days, but it’s carefully prepared and intensely flavorful. (Clay Oven, not coincidentally, has a number of older siblings around the city, including India Clay Oven in the Richmond, as well as a namesake Clay Oven in San Mateo.) The only real disappointments for me were the pappadum ($1), the crinkly lentil wafers, which were cold and therefore a little flat, and the palak pakora ($3.50), fritters of spinach in a batter of chickpea flour — also cold, and apparently fried (well ahead of time) in rancid oil.

Other than that: satisfaction. How about tandoori chicken, which is so cliché that it transcends cliché? You would expect a place called Clay Oven to have a pretty good version, since a tandoor is a clay oven, and Clay Oven’s version ($9.95 for a half bird) is exemplary, very tender and juicy, with the requisite reddish pink color (from the seasoned yogurt marinade), presented on a sizzling iron platter with slivers of onion and quartered lemons.

But we were pleased too to find tandoori chicken meat turning up in a dish called chicken makhai ($10.95): chunks of boneless flesh swimming in a voluptuous, spicy sauce very similar to that of chicken tikka masala. The restaurant offers this latter preparation too ($11.95), the only difference being … well, we couldn’t really detect any difference. If you’re concerned about the heat factor, incidentally, you needn’t worry, since the kitchen will tune the food’s fieriness to your specification.

Vegetarian dishes, as is typical at South Asian restaurants, are more than sufficient if you are a shunner of flesh. Saag paneer ($8.95) struck us as unusually and agreeably creamy, with a heavy allotment of white cheese, while chana masala ($7.95) — chickpeas cooked in a spicy gravy — was rich in said gravy, which helped allay any sense of dryness. (Chickpeas can be chalky.) Rice, of course, is offered to help capture the sauces of all of these dishes, but the breads work just as nicely, from a simple, well-blistered naan ($1.95) to a whole-wheat chapati ($1.50) glistening with oil.

Some of the humblest of dishes were among the most memorable. A cucumber salad ($2.75) turned out not to be a yogurty raita (though raita is available) but instead a heap of peeled coins sprinkled with salt and curry powder. And mulligatawny soup ($3.50), a hearty combination of shredded chicken and rice, was Soup Nazi–worthy, though served in a dainty little bowl. Ordinarily I might have hoped for a slightly bigger serving, but the world is not ordinary in the wake of Thanksgiving. So: two cheers yet again for little bowls of soup, and a dessert menu (of such usual suspects as rice pudding and saffron ice cream) from which one can abstain with a clear conscience. *

Years ago I ended up at a San Francisco Water Department dinner with my father and an old neighborhood friend, eating in the back hall of a half-century-old Italian restaurant in the Excelsior. The room spilled over with thick-armed men who were union, white, and not bad-off and from whom I learned a thing or two about old San Francisco family names and accents that tell you if someone is from the Richmond, the old Castro, or Balboa. It was a return to the blue-collar ‘Frisco that I was raised in: a posthippie, pre-dot-com city with a ubiquitous — and at one time iconic — KFOG, 104.5 FM, playlist composed of harder rockers by the Stones, Creedence, and the Beatles. My earliest memories of the city are tied to those songs, moaning from tiny car speakers, rattling empty cans of Bud, and wafting over garages that smelled of grease.

Yet there was one member of this blue-collar pantheon I could never get too close to. He was too bombastic. His character was too huge. Even before ingesting punk rock ideology via Maximumrocknroll and Epicenter, I felt in opposition to the stadium and the spectacle. Somehow I had internalized a belief that the Boss was my enemy.

Yet this year I found myself buying Magic (Sony), Bruce Springsteen’s latest album, literally on sight. My teenage self would have been horrified to know that at 30 I would be purchasing a Springsteen record not in spite of the E Street Band but because of it, and that after listening to it again and again, my greatest criticism would be that it has too few Clarence Clemons sax solos. The truth is that I’ve moved well past being appreciative of the man and into the realm of the fan — the kind who marks his Slingshot planner with the date and time tickets go on sale for Springsteen’s latest tour.

As with many young men with elitist tastes, it was Nebraska (Sony, 1982) that broke me. With its high-contrast cover, four-track production, and the slap-back reverb echoing of Suicide, the album suggested an almost punk quality, and it subverted all of my assumptions about Springsteen’s gross theatrics. Here was a serious songwriter with compassion for working people, concern for their dignity, and a subtle hint of darkness. Suddenly, I was listening, and, as I began to discover, so were my friends.

What surprised me most was the nonlinearity and consistency of his politics. Springsteen isn’t partisan, pro-union, antiwar, or above it all. He’s for ordinary people and their battles with life, injustice, and the institutions that seem set on killing their dreams, if not destroying the dreamers. It turns out that "Born in the U.S.A." isn’t a nationalist anthem but an indictment. He takes on police, poverty, and racism with "American Skin (41 Shots)," whose title pointedly refers to the slaying of Amadou Diallo by the New York Police Department. Springsteen is a humanist who never wanted to choose sides in the process of choosing between right and wrong. Perhaps for good reason — it’s hard not to wonder whether Clear Channel radio stations’ boycott of Magic isn’t linked to his fateful decision to openly oppose George W. Bush during the 2004 election.

My slow-burning appreciation for Springsteen’s moral and political iconoclasm wasn’t what really set my obsession with him into high gear. It was the unexpected but inevitable emotional connection that grew. Before I knew it, I was sitting in the dark listening to The River (Sony, 1980) and crying to its titular masterpiece. Conversion is strange, and when a person goes from being outside the church pews to singing in the choir it’s a hard thing to explain to anyone. I can listen to "Atlantic City," "The Promised Land," or even Magic‘s "Long Walk Home" and feel the agony of every person who’s ever loved or lost. I realize I’m willing to give up being aesthetically correct, intellectually above it all, and emotionally safe just to have something I can share with people who seem to live such different lives. Certainly it’s worth it to be transported back home, which makes Magic less like a throwback and more like a time machine. *

3. Top new band from my old hometown, Oakland: Zeroth

Just when I thought I couldn’t be surprised by anything anymore. A trio of smarter than average weirdos, they’ve produced the kind of strangeness that lends itself to nonsense descriptors like "electric ovarian space prog." My butt shook.

4. Top trend: pop noise albums

Though this is really a trend that started a few years ago with records like Burning Star Core’s The Very Heart of the World (Thin Wrist, 2005) and Prurient’s Black Vase (Load, 2005), 2007 saw some of America’s noise heavyweights releasing major statements with actual production values. Mouthus, John Wiese, and Religious Knives all brought great records, but perhaps most startling were the sweet clarity and depth of Sighting’s Through the Panama (Load/Ecstatic Peace).

5. Top label A&R: Southern Lord

They’ve made a pretty clean sweep of the best of left-field cult metal: OM, Wolves in the Throne Room, Velvet Cacoon, Abruptum, and Striborg. My only question is, where’s WOLD?

Le P’tit Laurent

Although for years I have believed and maintained that you could never get good cassoulet in a restaurant, I find that I must now recant. You can get good cassoulet in at least one restaurant in this town, and that restaurant is Le P’tit Laurent, which opened a few months ago at the corner of Chenery and Diamond, in the heart of Glen Park’s utterly transformed commercial village.

The restaurant bears the name of its owner, Laurent Legendre, who was one of the partners in Clémentine, a late-’90s presence in the Inner Richmond. I never quite warmed to Clémentine, whose rather formal and correct French cooking seemed a little crimped after the exuberant whimsy of Alain Rondelli, previous holder of the Clement Street space. But no such ghost haunts Le P’tit Laurent, whose predecessor was a blues club named Red Rock. The new bistro already feels as if it’s been there since time out of mind; it has that nicely worn-in Parisian look, from the clutter of liquor bottles (and a miniature Eiffel Tower) behind the mirrored bar to the little, distinctively French signs posted all over the place, including one for cave at the mouth of the wine closet. There is also a pressed-tin ceiling and a service ethic that is French in the best sense: friendly, yes, but knowledgeable and crisp first.

Best of all is the street scene that continuously unfolds beyond the many windows. One of the drawbacks of the French bistro in America is that America isn’t France, and our street scenes don’t look French. Glen Park would never be mistaken for the Marais, even at night, but one evening, amid early darkness and the descending scent of winter, I thought I caught a whiff of the 11th arrondissement: blurred streetlamps, a metro station at the corner, pedestrians hurrying home from work up quiet side streets, though not carrying baguettes under their arms.

Of course, I was eating an excellent cassoulet at the time, and this might have affected my perception. The only flaw in Le P’tit Laurent’s cassoulet ($19) is that it can’t be ordered as part of the three-course, $19.95 prix fixe menu (available Monday to Thursday, from 5:30 to 7 p.m.). Otherwise, the dish is flawless: an earthenware crock of white beans in a sauce thickened by a long, slow simmer with duck-leg confit, chunks of pork, and oblong coins of Toulouse sausage.

The cassoulet is a meal in itself and then some, so our first course — steamed mussels in a creamy white-wine sauce ($9), with pale gold frites ($2.50 extra) — was overkill in the form of an overture. (Prekill?) The broth was excellent if conventional, and it seemed to gather a bit of extra magic when sopped up with the fries or (when they ran out, because of course they did) chunks of baguette. And it probably made more sense as a prelude to a lighter main course, such as sautéed sea bass ($16) in a Grenobloise sauce — a rather forceful concoction of melted butter spiked with herbs and capers (and possibly a dab of mustard, I thought).

One of the kitchen’s themes, in fact, seems to involve giving hearty treatments to seafood. On an earlier visit we found several chunks of monkfish ($17.95) sprawled on a bed of shredded cabbage and bacon (a combination reminiscent of the Alsatian dish choucroute). On that same visit we liked suprême de poulet ($14.95), a roasted leg and thigh of chicken on a bed of couscous and garlic confit, with a cheery sauce of citrus reduction and ginger, but were less enthusiastic about the vegetarian plate ($14.95), a pair of large, free-form ravioli stuffed with red beet slices and bathed in too much of a decent but unremarkable mushroom sauce. If you needed proof that the traditional French gastronomic ethic is unenthusiastic about vegetarianism, I give you exhibit A.

If we felt we’d drifted into an unstated conflict, we were soon mollified by dessert: to wit, profiteroles ($5.95), in fact the best profiteroles in recent memory. There was nothing too out of the ordinary about the flavors; the pastry balls were stuffed with vanilla ice cream and sauced with chocolate and caramel. But the pastry! Sublimely flaky. Profiteroles are too often tough and rubbery, like old racquetballs, but Le P’tit Laurent’s were yieldingly delicate, bits of buttery finery that surrendered themselves and were soon gone but not forgotten. They were so not forgotten, in fact, that we ordered them a second time a few evenings later, and while I was tempted to cap things off with a snifter of Armagnac, I felt no need in the end. (To paraphrase the endlessly paraphrasable Homer Simpson: my gastronomic rapacity did know satiety.)

As for Glen Park — well, these days I hardly know ye. When Chenery Park opened just a few doors up in 2000, it was a lonely outpost of upscaleness in a Sleepy Hollow sort of urban enclave that seemed little changed since the 1950s. But these first years of the new millennium have brought all sorts of newness, from the cool pizza place across the street (Gialina) to the gorgeous Canyon Market (viewable through Le P’tit Laurent’s windows as part of the faux–11th arrondissement display) to, finally, a retro-chic Parisian bistro that serves quite good food at reasonable prices and is, accordingly, packing them in. The case for cassoulet has been made.

Presidio gets a Starbucks

GREEN CITY First came the troubling mandate that the Presidio needed to break even financially, a new model for a national park area. Then came the Starbucks. That’s right: the Guardian has learned that a Starbucks will open next month in the Presidio’s Letterman Digital Arts Center, replacing locally owned Perk Presidio.

The new Starbucks — and all it represents — has raised the ire of both park and city activists. Scott Silver, executive director of Wild Wilderness, based in Bend, Ore., is concerned that the Presidio’s self-funding requirement is a harbinger of things to come across federal land management agencies. He says other properties following the Presidio model include Fort Baker in Marin, Sandy Hook in New Jersey, Valles Caldera National Preserve in New Mexico (Forest Service land), and Fort Monroe in Virginia.

"It brings the entire standard of our national park system down from a high pedestal to a pretty base commercial reality," Silver said. "I just look at the Presidio as the first in what I fear will be a long chain of national parks that move away from the model of a publicly funded public good to a privately funded, largely commercial extension of our commercial world that’s really not in any way what we associate with national parks."

City activists point to Proposition G, which passed by a healthy 16 percent margin in 2006, requiring formula retail stores to get conditional use authorization from the Planning Commission before opening in neighborhood commercial districts. Richmond District residents demonstrated the power of this legislation in September by blocking a Starbucks slated for Fifth Avenue and Geary.

Dean Preston, a neighborhood activist and attorney launching a statewide organization called Tenants Together, said, "The law specifically applies to neighborhood commercial districts, but I think those same people who live in neighborhood commercial districts are using the Presidio, which is here in their backyard. I think that whether or not [Letterman Digital Arts] is subject to local law on the issue, they should be taking into account that city sentiment when deciding what kind of businesses to lease there."

Raul Saavedra, leasing director for Letterman Digital Arts, told us he didn’t know about Prop. G but that the company is aware that some people have opinions about Starbucks. That’s why the LDA originally selected Perk Presidio for the space. "We wanted someone like that to be successful," Saavedra said. "And they weren’t, unfortunately."

So the LDA decided to look for a new vendor, considering sole proprietors and local and national chains. Saavedra said the smaller operators he considered had credit issues and concerns about making the location successful. He said the key factors in selecting Starbucks were its strong credit, good service, and solid sustainability program.

Dana Polk, the Presidio Trust’s senior adviser for government and media relations, said that as master tenant, the LDA is free to sublet that space to any company it chooses. Nevertheless, Saavedra indicated that the LDA anticipated possible concerns with choosing Starbucks: "We went to the trust before we signed the deal with Starbucks, because we knew that there would probably be some opinions. And at that time there was no problem."

This will not be the first national park area to host a Starbucks. That dubious honor goes to the San Francisco Maritime National Historic Park, which since October 2004 has housed a Starbucks as a subtenant of Kimpton Resorts in its Hazlett Warehouse, according to Shelley Niedernhofer, chief of administration and business services for the park.

However, National Park Service concessions program specialist manager Jo Pendry confirms that these Starbucks are the first examples of formula retail throughout the 391-site national park system.

Kim Winston, Starbucks manager of civic and community affairs for the western region, claimed that revenues from the Starbucks help fund National Parks Service operations, but Niedernhofer said of the Maritime Park, "We don’t receive any revenue directly from Starbucks." The Presidio arrangement will be similar.

But Preston isn’t mollified. He said, "To have a Starbucks go into the Presidio with no real public review right after a Starbucks is nearly unanimously blocked [by a Board of Supervisors’ vote] in the Inner Richmond does seem like a real contrast. The fact that there’s absolutely no public process for putting a Starbucks in such a visible spot is really a problem." *

Iron and Wine is what happens when you’re making plans for Friday night

So the night, Nov. 30, was a disaster of sorts but not for the reasons you’d think – and before you gag yourself with the prospect of another music review-turned personal soapbox or group session, bear with me. I’d like to think there is a point to my mawkishness. There is a certain regimen that proceeds from a typical Friday evening in the Bay that includes: 1) Driving with abandon, windows down, sunroof retracted, a hurly-burly of pre-weekend tune-age, a ritualized exorcising of the week’s frustrations, fleeting Bay vistas obstructed by billboards to the right and a swathe of mountains to the left; 2) The trickle of evening that always seem to greet you at that asymptote of the Peninsula where the sepia tones of suburbia meets the neon city with its bleary-eyed halogens and dayglo pleasuredoms; 3) A fine meal, which is to say nothing in moderation and everything in excess; and 4) A moment of love, nostalgia, tomfoolery, or any of a number of sensuous terms that might describe the simple, inexplicable pleasures that only live music can afford us – jouissance, freude, orphic plaisir, or, at the very least, “like a monkey making love to a skunk – maybe didn’t get all he wanted, but got all he could stand…”

Of course, you see, it didn’t happen that way. Driving up the 101 in Friday rush-hour has its occasional pleasures and aesthetic appeals but not when dinner reservations in the Mission and a hop-skip-jump over the Bay Bridge are timed out perfectly to coincide with Sam Beam’s performance at the Paramount. Over an hour parked in the concrete desert is a numbing death-trip. Honk. Break. Lurch. Then there’s the inevitable parking morass that is downtown SF: where one parks in the Richmond to play on Harrison – and the confusing cell-phone tag-games that often delay dinner reservations and sometimes end friendships.

Reservations cancelled, eh?

What?! 7:30 already! I’m barely through the second scotch and soda and already it’s time to move on. Back onto the road and across the great steel artery leaving the flickering night of the city before it’s even begun in earnest. Wait…wait…where’s my WALLET?!

Believe it or not, we all might learn a thing or two from Iron and Wine’s Sam Beam – namely, not to sweat the little things and embrace your quotidian flaws. His Hirsuiteness took the cavernous auditorium of the Paramount on Nov. 30 for two hours of brittle ballads and po’ boy twee pop.

Shopping for slackers

When it comes to holiday shopping, some people are planners. These are the types who keep an eye out for potential gifts all year long, who spend long, leisurely hours trekking through shopping districts and browsing through stores for that perfect gift — in June. The proposed Central Subway project has arrived at a critical point in its planning stage, with the public comment period for its environmental documents coming to a close Dec. 10 after a series of recent workshops and meetings.

Proponents see the project as an important next stage of the Third Street Light Rail Project and a vital link to Chinatown, which was made less accessible when the Embarcadero Freeway was torn down. But even some transit advocates question whether the project, with a price tag of $1.2–$1.7 billion, has enough bang for the buck to be worth it.

The Central Subway would realize the San Francisco Municipal Transportation Agency’s long-standing vision for a subway system that links to the northeast sector of the city, alleviates traffic problems, and improves connections with BART and Caltrain.

This phase of the project, which proposes to connect the South of Market area to Chinatown by underground rail by 2016, has received the fiscal green light — $1.2 billion in state and federal funding is already pledged.

Board of Supervisors president Aaron Peskin, whose District 3 includes Chinatown, called the Central Subway "a very good and wise investment in San Francisco.

"Any investment in public transportation is a good thing," he added. "Is it expensive? Yes. But so were" many other transit projects.

Rose Pak of the Chinese Chamber of Commerce, an influential force in San Francisco politics, insists that the Central Subway project is imperative to the Chinatown community.

"It’s long overdue," she told the Guardian. "Over 70 percent of our people rely exclusively on public transit. It’s very important to them. They don’t own cars, but they still need to get here for work, to see friends and family."

But is a 1.7-mile stretch of subway the right priority for and the right way to spend San Francisco’s scarce transportation money? Tom Radulovich, elected BART board member and executive director of Livable City, said making the Central Subway a top priority is a "big mistake."

"If everything else was well with Muni, this might be a good project," he told us. "But we need to take care of first things first."

Radulovich emphasized that improving the existing Muni service is a better step toward resolving San Francisco’s transit problems. He pointed out that using state and federal government money for other projects would go a lot further in improving the overall system. He said the Central Subway project is prematurely being made a priority.

"It’s like trying to build a master bedroom suite on top of a foundation that needs reinforcement. It’s nice, but it doesn’t make much sense," he said.

When asked about the possibility of revamping the Muni bus lines that presently serve Chinatown, Pak explained that the existing bus service already functions at capacity.

"Stockton is one of the busiest streets in San Francisco," she said. "Have you ever tried to ride a bus there at rush hour? It’s almost impossible."

In fact, the project’s Supplemental Environment Impact Report states that bus service already runs at three-minute frequencies or better for most of the Central Subway corridor. It also affirms that the area is operating at capacity, "particularly Stockton Street."

Pak added that the Central Subway would allow for shorter transit times and a "minimum disruption of surface streets."

After the Embarcadero Freeway was disabled by the 1989 Loma Prieta earthquake, the decision was made to remove and not replace it. That angered many Chinatown merchants, who became the base of support for the Central Subway project.

At first the group "didn’t have the muscle nor the power," Pak told us. "But our community rallied. We did massive letter writing and postcard writing."

Now challenging the project or raising concerns about its cost or feasibility — which some critics and media reports have done — means doing battle with Pak and the Chinese American community, a substantial voting block. So Mayor Gavin Newsom, Sup. Peskin, and other top elected officials support the project.

At the San Francisco Planning Commission meeting held Nov. 15, David Chiu, a commissioner on the Small Business Commission (and candidate to succeed Peskin as District 3 supervisor), said he was "really looking forward to this project moving forward" but would like to see more detail in the SEIR about the process for relocating small businesses.

Commissioner Michael Antonini "strongly advised" extending the subway as soon as possible to North Beach and Fisherman’s Wharf and all the way to the Richmond, arguing the current terminus in Chinatown doesn’t make long-term sense. But few at the hearing argued the project shouldn’t be built.

According to the SEIR, traveling from Fourth Street and King to Chinatown on the Central Subway would cut up to 12.4 minutes from the journey in 2030 — from the bus time projection of 17 minutes to less than five minutes in one subway alignment alternative.

Four "Alignment Alternatives," or designs for how the subway will be built, are laid out in the SEIR, which was released for public review Oct. 17 and made the subject of three community workshops and a Planning Commission hearing.

Options range from enhanced bus service and no subway to one that includes some surface rail along Fourth Street (with a new station at Moscone Center) to an option with more of the route underground and Chinatown stations in various spots.

Once an alignment plan is chosen, the SFMTA will vote on the final design next year. And if things go smoothly, construction on the project could start in 2010 and service begin in 2016.

Green City: The bay-delta connection

GREEN CITY Until recently, politicians and the public tended to view the problems facing the Sacramento–San Joaquin Delta levees as separate from the problems facing the San Francisco Bay. But now that human-made distinction is beginning to blur as scientists predict that rising sea levels and levee failures could have profound consequences for both ecosystems.

As wetlands scientist Philip Williams explained at the State of the Estuary Conference in Oakland last month, if the levees fail, a hole will open that will cause the northern area where the bay meets the delta (roughly from Richmond to Antioch) to fill with salt water and deepen, thereby eroding the delta’s valuable tidal marsh habitat.

This doomsday scenario has environmentalists clamoring for an increase in tidal marsh restoration efforts in the southernmost stretches of the bay, which are already home to the South Bay Salt Pond Restoration Project and a broader US Army Corps of Engineers effort to build levees and restore marshlands to protect property from flooding.

As Dr. Letitia Grenier of the San Francisco Estuary Institute said at the SOE conference, people aren’t the only ones who need habitat protection. The mosquito-eating Yuma bat, the California clapper rail, the least tern, and the chinook salmon are just a few of the many species that live around, fly across, or swim through the bay and the delta, and their survival depends on a mosaic of interconnected habitats.

Yet no agency has the clear authority to require that marshland marsh be restored, levees built, development prevented, and greenhouse gas emissions reduced.

In a recent report for the San Francisco Bay Conservation and Development Commission, executive director Will Travis notes that while the BCDC, the Bay Area Air Quality Management District, the Metropolitan Transportation Commission, and the Association of Bay Area Governments are working together as part of a Joint Policy Committee, "none of the four agencies has the authority to prohibit development in flood-prone areas [or] require that levees be constructed to protect low-lying areas, and BAAQMD does not have the authority to regulate emissions from vehicles."

Pointing out that the BCDC was created in 1965 to regulate bay fill and thus prevent the bay from becoming smaller, Travis writes that his agency "is neither legally responsible for dealing with this dramatic change of conditions that is making the Bay larger, nor does BCDC have any explicit legal authority to address this problem."

That said, in an Oct. 29 report posted on the BCDC’s Web site, Travis announced that his agency "has taken the initiative to formulate a broad outline of a comprehensive strategy for addressing climate change in the Bay region and identified changes that are needed in state law so that BCDC can play a productive role in implementing such a strategy."

This strategy includes mapping flood-prone areas, ceasing planned developments in such areas, identifying property that requires protection, and identifying areas that should be allowed to revert to tidal marsh and other types of natural habitat.

"Another probable impact of climate change is that more precipitation in the Sierra Nevada will fall as rain rather than snow, and the snow pack will melt earlier in the spring," Travis writes. This will in turn reduce the amount of late spring and summer runoff into the delta, allowing salt water to extend farther into the delta than it does now.

Travis predicts that sea level rise and higher flood flows resulting from climate change, as well as earthquake risk, will also increase the probability of catastrophic levee failure. Travis also notes that "pulling existing development back from the Bay shoreline and foregoing planned development of low-lying areas can provide an opportunity to expand the restoration of tidal wetlands."

To address these challenges, the BCDC is proposing an eight-year work program with the goal of achieving environmental accountability. "Any proposed new development within the area likely to be inundated by sea level rise should be required to obtain approval both from the local government and from BCDC."

But first, the BCDC or a new regional agency will need state legislation giving it that authority — and public recognition that seriously dealing with climate change means accepting some new regulation of private property.

San Francisco is at a crossroads. The streets are congested, Muni has slowed to a crawl, greenhouse gas emissions are at all-time highs, and the towers of new housing now being built threaten to make all of these transportation-related problems worse.

The problems are complicated and defy simply sloganeering — but they aren’t unsolvable. In fact, there’s remarkable consensus in San Francisco about what needs to be done. The people with advanced degrees in transportation and city planning, the mayor and almost all of the supervisors, the labor and environmental movements, the urban planning organizations, the radical left and the mainstream Democrats — everyone without an ideological aversion to government is on the same page here.

The city planners and transportation experts, who have the full support of the grass roots on this issue, are pushing a wide range of solutions: administrative and technical changes to make Muni more efficient, innovative congestion management programs, high-tech meters that use market principles to free up needed parking spaces, creative incentives to discourage solo car trips, capital projects from new bike and rapid-transit lanes to the Central Subway and high-speed rail, and many more ideas.

In fact, the coming year promises a plethora of fresh transportation initiatives. The long-awaited Transit Effectiveness Project recommendations come out in early 2008, followed by those from the San Francisco County Transportation Authority’s Mobility, Access, and Pricing Study (an unprecedented, federally funded effort to reduce congestion here and in four other big cities), an end to the court injunction against new bicycle projects, and a November bond measure that would fund high-speed rail service between downtown San Francisco and Los Angeles.

But first, San Franciscans have to get past a few downtown developers and power brokers who have a simplistic, populist-sounding campaign that could totally undermine smart transportation planning.

On Nov. 6, San Franciscans will vote on propositions A and H, two competing transportation measures that could greatly help or hinder the quest for smart solutions to the current problems. Prop. A would give more money and authority to the San Francisco Metropolitan Transportation Agency while demanding it improve Muni and meet climate change goals.

Prop. H, which was placed on the ballot by a few powerful Republicans, most notably Gap founder Don Fisher (who has contributed $180,000 to the Yes on H campaign), would invalidate current city policies to allow essentially unrestricted construction of new parking lots.

New parking turns into more cars, more cars create congestion, congestion slows down bus service, slow buses frustrate riders, who get back into their cars — and the cycle continues. It’s transit against traffic, and the stakes couldn’t be higher.

"If we are serious about doing something about global warming, it’s time to address the elephant in the room: people are going to have to drive less and take transit more" was how the issue was framed in a recent editorial cowritten by Sup. Sean Elsbernd, arguably the board’s most conservative member, and Sup. Aaron Peskin, who wrote Prop. A.

Peskin says Prop. H, which Prop. A would invalidate, is the most damaging and regressive initiative he’s seen in his political life. But the battle for hearts and minds won’t be easy, because the downtown forces are taking a viscerally popular approach and running against city hall.

The San Francisco Examiner endorsed Prop. H on Oct. 22, framing the conflict as between the common sense of "your friends and neighbors" and "a social-engineering philosophy driven by an anti-car and anti-business Board of Supervisors." If the Examiner editorialists were being honest, they probably also should have mentioned Mayor Gavin Newsom, who joins the board majority (and every local environmental and urban-planning group) in supporting Prop. A and opposing Prop. H.

The editorial excoriates "most city politicians and planners" for believing the numerous studies that conclude that people who have their own parking spots are more likely to drive and that more parking generally creates more traffic. The Planning Department, for example, estimates Prop. H "could lead to an increase over the next 20 years of up to approximately 8,200–19,000 additional commute cars (mostly at peak hours) over the baseline existing controls."

"Many, many actual residents disagree, believing that — no matter what the social engineers at City Hall tell you — adding more parking spaces would make The City a far more livable place," the Examiner wrote.

That’s why environmentalists and smart-growth advocates say Prop. H is so insidious. It was written to appeal, in a very simplistic way, to people’s real and understandable frustration over finding a parking spot. But the solution it proffers would make all forms of transportation — driving, walking, transit, and bicycling — remarkably less efficient, as even the Examiner has recognized.

You see, the Examiner was opposed to Prop. H just a couple of months ago, a position the paper recently reversed without really explaining why, except to justify it with reactionary rhetoric such as "Let the politicians know you’re tired of being told you’re a second-class citizen if you drive a car in San Francisco."

Examiner executive editor Jim Pimentel denies the flip-flop was a favor that the Republican billionaire who owns the Examiner, Phil Anschutz, paid to the Republican billionaire who is funding Prop. H, Fisher. "We reserve the right to change on positions," Pimentel told me.

Yet it’s worth considering what the Examiner originally wrote in an Aug. 2 editorial, where it acknowledged people’s desire for more parking but took into account what the measure would do to downtown San Francisco.

The paper wrote, "Closer examination reveals this well-intentioned parking measure as a veritable minefield of unintended consequences. It could actually take away parking, harm business, reduce new housing and drive out neighborhood retail. By now, Californians should be wary of unexpected mischief unleashed from propositions that legislate by direct referendum. Like all propositions, Parking For Neighborhoods was entirely written by its backers. As such, it was never vetted by public feedback or legislative debate. If the initiative organizers had faced harder questioning, they might have recognized that merely adding parking to a fast-growing downtown is likely to make already-bad traffic congestion dramatically worse."

The San Francisco Transportation Authority’s Oct. 17 public workshop, which launched the San Francisco Mobility, Access, and Pricing Study, had nothing to do with Props. A and H — at least not directly. But the sobering situation the workshop laid out certainly supports the assessment that drawing more cars downtown "is likely to make already-bad traffic congestion dramatically worse."

City planners and consultants from PBS&J offered some statistics from their initial studies:

San Francisco has the second-most congested downtown in the country, according to traffic analysts and surveys of locals and tourists, about 90 percent of whom say the congestion is unacceptably bad compared to that of other cities.

Traffic congestion cost the San Francisco economy $2.3 billion in 2005 through slowed commerce, commuter delays, wasted fuel, and environmental impacts.

The length of car trips is roughly doubled by traffic congestion — and getting longer every year — exacerbating the fact that 47 percent of the city’s greenhouse gas emissions come from private cars. Census data also show that more San Franciscans get to work by driving alone in their cars than by any other mode.

Traffic has also steadily slowed Muni, which often shares space with cars, to an average of 8 mph, making it the slowest transit service in the country. Buses now take about twice as long as cars to make the same trip, which discourages their use.

"We want to figure out ways to get people in a more efficient mode of transportation," Zabe Bent, a senior planner with the TA, told the crowd. She added, "We want to make sure congestion is not hindering our growth."

The group is now studying the problem and plans to reveal its preliminary results next spring and recommendations by summer 2008. Among the many tools being contemplated are fees for driving downtown or into other congested parts of the city (similar to programs in London, Rome, and Stockholm, Sweden) and high-tech tools for managing parking (such as the determination of variable rates based on real-time demand, more efficient direction to available spots, and easy ways to feed the meter remotely).

"As a way to manage the scarce resource of parking, we would use pricing as a tool," said Tilly Chang, also a senior planner with the TA, noting that high prices can encourage more turnover at times when demand is high.

Yet there was a visceral backlash at the workshop to such scientifically based plans, which conservatives deride as social engineering. "I don’t understand why we need to spend so much money creating a bureaucracy," one scowling attendee around retirement age said. There were some murmurs of support in the crowd.

Rob Black, the government affairs director for the San Francisco Chamber of Commerce, which is the most significant entity to oppose Prop. A and support Prop. H, was quietly watching the proceedings. I asked what he and the chamber thought of the study and its goals.

"We have mixed feelings, and we don’t know what’s going to happen," Black, who ran unsuccessfully against Sup. Chris Daly last year, told me. "The devil is in the details."

But others don’t even want to wait for the details. Alex Belenson, an advertising consultant and Richmond District resident who primarily uses his car to get around town, chastised the planners for overcomplicating what he sees as a "simple" problem.

Vocally and in a four-page memo he handed out, Belenson blamed congestion on the lack of parking spaces, the city’s transit-first policy, and the failure to build more freeways in the city. Strangely, he supports his point with facts that include "Total commuters into, out of, and within San Francisco have only increased by 206,000 since 1960 — more than 145,000 on public transit."

Some might see those figures, derived from census data, as supporting the need for creative congestion management solutions and the expansion of transit and other alternative transportation options. But Belenson simply sees the need for 60,000 new parking spaces.

As he told the gathering, "If someone wants to build a parking lot and the market will support it, they should be able to."

The San Francisco Planning and Urban Research Association (SPUR) is generally allied with the downtown business community on most issues, but not Props. A and H, which SPUR says could be unmitigated disasters for San Francisco.

"SPUR is a pro-growth organization, and we want a healthy economy. And we think the only way to be pro-business and pro-growth in San Francisco is to be transit reliant instead of car reliant," SPUR executive director Gabriel Metcalf told me in an interview in his downtown office.

He agreed with Belenson that the free market will provide lots of new parking if it’s allowed to do so, particularly because the regulatory restrictions on parking have artificially inflated its value. "But the negative externalities are very large," Metcalf said, employing the language of market economics.

In other words, the costs of all of that new parking won’t be borne just by the developers and the drivers but by all of the people affected by climate change, air pollution, congested commerce, oil wars, slow public transit, and the myriad other hidden by-products of the car culture that we are just now starting to understand fully.

Yet Metcalf doesn’t focus on that broad critique as much as on the simple reality that SPUR knows all too well: downtown San Francisco was designed for transit, not cars, to be the primary mode of transportation.

"Downtown San Francisco is one of the great planning success stories in America," Metcalf said. "But trips to downtown San Francisco can’t use mostly single-occupant vehicles. We could never have had this level of employment or real estate values if we had relied on car-oriented modes for downtown."

Metcalf and other local urban planners tell stories of how San Francisco long ago broke with the country’s dominant post–World War II development patterns, starting with citizen revolts against freeway plans in the 1950s and picking up stream with the environmental and social justice movements of the 1960s, the arrival of BART downtown in 1973, the official declaration of a transit-first policy in the ’80s, and the votes to dismantle the Central and Embarcadero freeways.

"We really led the way for how a modern dynamic city can grow in a way that is sustainable. And that decision has served us well for 30 years," Metcalf said.

Tom Radulovich, a longtime BART board member who serves as director of the nonprofit group Livable City, said San Franciscans now must choose whether they want to plan for growth like Copenhagen, Denmark, Paris, and Portland, Ore., or go with auto-dependent models, like Houston, Atlanta, and San Jose.

"Do we want transit or traffic? That’s really the choice. We have made progress as a city over the last 30 years, particularly with regard to how downtown develops," Radulovich said. "Can downtown and the neighborhoods coexist? Yes, but we need to grow jobs in ways that don’t increase traffic."

City officials acknowledge that some new parking may be needed.

"There may be places where it’s OK to add parking in San Francisco, but we have to be smart about it. We have to make sure it’s in places where it doesn’t create a breakdown in the system. We have to make sure it’s priced correctly, and we have to make sure it doesn’t destroy Muni’s ability to operate," Metcalf said. "The problem with Prop. H is it essentially decontrols parking everywhere. It prevents a smart approach to parking."

Yet the difficulty right now is in conveying such complexities against the "bureaucracy bad" argument against Prop. A and the "parking good" argument for Prop. H.

"We are trying to make complex arguments, and our opponents are making simple arguments, which makes it hard for us to win in a sound-bite culture," Radulovich said.

"Prop. H preys on people’s experience of trying to find a parking space," Metcalf said. "The problem is cities are complex, and this measure completely misunderstands what it takes to be a successful city."

When MTA director Nathaniel Ford arrived in San Francisco from Atlanta two years ago, he said, "it was clear as soon as I walked in the door that there was an underinvestment in the public transit system."

Prop. A would help that by directing more city funds to the MTA, starting with about $26 million per year. "I don’t want to say the situation is dire, but it’s certainly not going to get better without some infusion of cash to get us over the hump," Ford told the Guardian recently from his office above the intersection of Market and Van Ness.

The proposed extra money would barely get this long-underfunded agency up to modern standards, such as the use of a computer routing system. "We actually have circuit boards with a guy in a room with a soldering iron keeping it all together," Ford said with an incredulous smile.

The other thing that struck Ford when he arrived was the cumbersomeness of the MTA’s bureaucracy, from stifling union work rules to Byzantine processes for seemingly simple actions like accepting a grant, which requires action by the Board of Supervisors.

"Coming from an independent authority, I realized there were a lot more steps and procedures to getting anything done [at the MTA]," he said. "Some of the things in Prop. A relax those steps and procedures."

If it passes, Ford would be able to set work rules to maximize the efficiency of his employees, update the outdated transit infrastructure, set fees and fines to encourage the right mix of transportation modes, and issue bonds for new capital projects when the system reaches its limits. These are all things the urban planners say have to happen. "It should be easy to provide great urban transit," Metcalf said. "We’re not Tracy. We’re not Fremont. We’re San Francisco, and we should be able to do this."

Unfortunately, there are political barriers to such a reasonable approach to improving public transit. And the biggest hurdles for those who want better transit are getting Prop. A approved and defeating Prop. H.

"It’s clear to people who have worked on environmental issues that this is a monumental election," said Leah Shahum, director of the San Francisco Bicycle Coalition and an MTA board member. "San Francisco will choose one road or the other in terms of how our transportation system affects the environment. It will really be transit or traffic."

Shahum said the combination of denying the MTA the ability to improve transit and giving out huge new parking entitlements "will start a downward spiral for our transit system that nobody benefits from."

"We are already the slowest-operating system in the country," Ford said, later adding, "More cars on the streets of San Francisco will definitely have a negative impact on Muni."

But even those who believe in putting transit first know cars will still be a big part of the transportation mix.

"All of it needs to be properly managed. There are people who need to drive cars for legitimate reasons," Ford said. "If you do need to drive, you need to know there are costs to that driving. There is congestion. There are quality impacts, climate change, and it hurts transit."

"There are parking needs out there, and the city is starting to think of it in a more responsive way. We don’t need this to create more parking," Shahum said. "If folks can hold out and beat down this initiative, I do think we’re headed in the right direction."

Yet the Yes on A–No on H campaign is worried. Early polling showed a close race on Prop. A and a solid lead for Prop. H.

Fisher and the groups that are pushing Prop. H — the Council of District Merchants, the SF Chamber of Commerce, and the San Francisco Republican Party — chose what they knew would be a low-turnout election and are hoping that drivers’ desires for more parking will beat out more complicated arguments.

"The vast majority of San Franciscans call themselves environmentalists, and they want a better transit system," Shahum said, noting that such positions should cause them to support Prop. A and reject Prop. H. "But they’re at risk of being tricked by a Republican billionaire’s initiative with an attractive name…. Even folks that are well educated and paying attention could be tricked by this."

For Metcalf and the folks at SPUR, who helped write Prop. A, this election wasn’t supposed to be an epic battle between smart growth and car culture.

"For us, in a way, Prop. A is the more important measure," Metcalf said. "We want to focus on making Muni better instead of fighting about parking. We didn’t plan it this way, but the way it worked out, San Francisco is at a fork in the road. We can reinforce our transit-oriented urbanity or we can create a mainly car-dependent city that will look more like the rest of America."

Guards hit streets

More than 100 security guards from more than 20 buildings in the Financial District, including the Transamerica Building, participated in a three-day unfair-labor-practices strike before returning to work Sept. 27 as contract talks resumed.

After three months of working without a contract, security guards are seeking higher wages and access to affordable health care to be able to support their families, as well as proper training for the safety of buildings and their occupants.

Service Employees International Union Local 24/7 representatives were mostly pleased with the job action, although the union had to defend three guards who were locked out as the strike ended. Universal Protection Services had planned to permanently replace security officers Robert Ravare, Kevin Coleman, and Jesusa Villena, but the issue has since been resolved, and the three employees returned to work on the morning of Sept. 28.

Abbas Emady, a security guard for Universal, told the Guardian he resents security companies for not providing adequate training for their employees, which devalues the important role guards are likely to play in a disaster. And low wages and poor benefits exacerbate the problem by creating high turnover rates for guards.

"If there’s a terrorist attack or a fire, we’re the first to go," said Bobby Randall, who works for Securitas as a security guard at the 50 Fremont high-rise. Without sufficient training, security guards may have difficulty assisting police and firefighters in an emergency, a point the local police and firefighters unions reinforced with votes of support for the strike.

Security guards risk their lives to protect multibillion-dollar properties, yet they don’t receive the same wages or health coverage as janitors, window washers, parking attendants, or operating engineers who work in the same buildings. In fact, a security guard with two and half years of experience only makes $11.85 an hour, while a janitor with the same experience makes $17.05 an hour, according to the SEIU. A union-run "Justice for Janitors" organizing campaign a few years ago helped that group make progress.

"It’s an unacceptable double standard," SEIU Local 24/7 spokesperson Gina Bowers said.

Armando Yepez, who participated in the strike, told us he works two full-time jobs as a security guard, at a downtown high-rise and at a construction site, in order to pay for housing and other expenses. Yepez commutes between his home in Richmond and his job locations in San Francisco five times a week, leaving him with less than five hours of sleep each night.

Security officers often find themselves paying for medical expenses out of their own pockets because their health insurance does not cover all of their needs and does not provide family benefits.

On Jan. 1 security guards were offered a free but severely limited health plan with Aetna, which has a cap of $4,000 for outpatients. For Sue Trayling, a security guard working for Securitas, all it took was one night in the emergency room and a couple of doctor’s appointments to max out her Aetna plan. Trayling clocks in 421/2 hours a week yet still had to dish out $2,400 in cash to pay for additional medical expenses.

According to Trayling, security guards were offered health care plans with Kaiser Permanente for $26 per month before Jan. 1. Since then, however, premiums have gone up to about $140 per month, and the copayment has doubled from $20 to $40 per visit.

The first strike among private security officers in San Francisco found some official support — the Board of Supervisors passed a resolution Sept. 25 in favor of the security guards. Sup. Tom Ammiano stood before a small crowd of workers clad in purple T-shirts on the steps of City Hall and expressed the city’s support for higher wages, affordable health insurance, and proper training.

Mayor Gavin Newsom also issued a statement saying, "I urge the involved parties to work more diligently towards a fair and reasonable settlement — one that recognizes the economic concerns of the workers while at the same time respect[ing] the employers’ need for operating flexibility within the wide range of facilities in which they provide security services."

Newsom also asked commercial-building owners and managers to involve themselves in the negotiation process with the security companies in order to set new industry standards. The Building Owners and Managers Association did not return our call seeking comment on the strike and related issues.

Letters as leverage

It’s a thin, seemingly innocuous letter. The Social Security Administration mails it when names and Social Security numbers don’t match on an employee’s I-9 form. The intent is to make sure workers receive their benefits.

But unions and immigrants have long charged that unscrupulous employers use SSA "no match" letters to harass undocumented workers and squelch union organizing efforts. Now, after a failed immigration debate in Congress, the George W. Bush administration wants to pass a regulation that would explicitly turn the letter into an immigration enforcement tool.

Activists fear this could result in massive firings and retaliation against workers organizing with unions. Employers complain it could lead to an economic slump in industries dependent on undocumented labor. A temporary injunction granted by a San Francisco judge is the only thing holding back letters across the country; it ends Oct. 1.

Bay Area activists have been national leaders at the intersection of immigrant rights and labor movements. They are now shaping national policy on this new regulation in the courts and promise wide-scale street action and workplace walkouts if it goes into effect.

A look at past and present related Bay Area organizing may shed light on the future of the national issue.

BAY AREA ORGANIZING


US companies file hundreds of millions of W-2 forms with the SSA every year. The SSA uses them to calculate how much it owes workers at retirement. When the name and the Social Security number do not match, the SSA sends a "no match" letter to the employee to clear up the discrepancy. The letters are also sent to employers who have more than 10 employees with no match. These letters have nothing to do with immigration law, and employers are not required to take any adverse action against these employees.

But under the new Department of Homeland Security regulation, no-match letters may be seen as evidence that an employer knowingly employed an undocumented worker. The letters would include a leaflet from US Immigration and Customs Enforcement informing employers that they must fire workers who cannot resolve no matches with the SSA or reverify their work authorization within 93 days. If the companies do not, they may be subject to fines or criminal charges.

The rule was drafted more than a year ago but was not announced by Homeland Security secretary Michael Chertoff until Aug 10. "The magnet that brings most economic migrants into this country is work," he explained. "And if we have worksite enforcement directed at illegal employment, we strike at that magnet."

Brooke Anderson, an organizer with the East Bay Alliance for a Sustainable Economy, told the Guardian that this is an unlikely scenario. Workers will not leave the country; they will simply be forced into underground economies, rotate through different jobs, and become even more vulnerable.

Anderson was among a delegation of more than 30 labor, faith, and community leaders that presented a letter Aug. 30 at the regional SSA office in Richmond. The letter outlined their concerns and asked that the SSA send out no-match letters only to employees, not employers.

"DHS is using an incomplete, hodgepodge system intended to ensure our economic security to implement a regressive immigration policy that Bush failed to pass in Congress," Anderson told us. "The SSA as an agency should have a spine and say no to DHS and no to the Bush administration."

If the ICE inserts do go out with no-match letters, she predicts walkouts and massive street actions.

The regulation is also being challenged in a lawsuit filed by the Central Labor Council of Alameda County. The AFL-CIO, the American Civil Liberties Union, and the San Francisco Central Labor Council have joined it. The plaintiffs claim that because the SSA’s database is full of errors, many citizens and legal immigrants could end up losing their jobs. They also argue that the DHS has exceeded its authority by seeking to use the SSA to enforce immigration laws.

US District Judge Maxine Chesney in San Francisco granted a nationwide temporary restraining order Aug. 31, blocking the SSA from sending letters with ICE inserts. The order is in effect until Oct. 1, when another federal judge here, Charles Breyer, will decide whether to grant another injunction.

"DHS is trying to create a huge terror, to give the illusion that they are doing something," Bill Sokol, a lawyer with Weinberg, Roger, and Rosenfeld, the firm representing the Central Labor Council of Alameda County, told us. "Workers are afraid, but we must dial down people’s fear and terror under our new gestapo."

He said the law will have little impact if employers understand it and do not abuse it. If employers overreact, however, the result could be disastrous. Sokol said employers are already firing employees immediately after receiving the letters.

HISTORY


Unions and immigrant workers across the country have charged that no-match letters have been used to stifle workers’ rights since the SSA began sending them to employers in 1994. Activists in the Bay Area have played a key role in resisting these efforts, setting national precedents upholding worker rights.

When a San Francisco Travelodge fired workers after they began organizing with a union in 1999, allegedly due to Social Security no matches, the terminated employees took it to court. The next year they won an arbitrator’s decision that the firing, based solely on no-match letters, was a violation of their union contract.

Local community pressure on the SSA also resulted in the inclusion of cautionary text in the letter. The no-match letter now states that employers "should not use this letter to take any adverse action against an employee…. Doing so could, in fact, violate state or federal law and subject you to legal consequences."

Activists at Oakland’s Labor Immigrant Organizers Network wrote a resolution in 1999 asking the AFL-CIO to renounce its support of the employer-sanctions provisions of the 1986 Immigration Reform and Control Act, the federal law that for the first time made it illegal for an undocumented worker to hold a job. Their agitation is credited in part for a resolution the AFL-CIO passed in 2000 calling for the repeal of sanctions and for a legalization program for undocumented workers.

The letters remained a potent tool for antiunion activity. A 2003 survey by the Center for Urban Economic Development at the University of Illinois at Chicago found that 25 percent of workers listed in no-match letters reported that their employers fired them in retaliation for complaining about inadequate worksite conditions. More than one in five workers reported that their employer fired them in retaliation for union activity.

San Francisco opposed the DHS no-match regulation when it was proposed last year. An August 2006 resolution by the Board of Supervisors said it may lead to employers "using it as a device to fire, intimidate, harass, or underpay employees." It promised that the city would defy the regulation if it received a no-match letter for a city employee.

The San Francisco Chamber of Commerce and the US Chamber of Commerce also came out against the regulation.

But some employers embraced the proposed regulation. Uniform manufacturer Cintas fired hundreds of employees across the country, allegedly responding to the proposed guidelines after receiving no-match letters during a union organizing drive. Organizers said the company targeted employees involved in the union and jumped the gun on new regulations.

The Woodfin Suite Hotel in Emeryville fired 21 housekeepers in December 2006, also allegedly due to no-match letters. The workers claim the Woodfin retaliated against them for organizing with the East Bay Alliance for a Sustainable Economy, a labor-affiliated think tank, to enforce the living-wage law (see "Calling in the Feds," 6/13/07).

A yearlong campaign targeting the Woodfin has brought the issue to a national audience.

FALSE INFORMATION


Organizers say the regulations are far less strict than the news media has portrayed them, adding to an atmosphere of hysteria and fear among employers and workers. Francisco Ugarte, a lawyer with the Oakland firm of Leonard Carder, held up several San Francisco Chronicle articles at a Sept. 13 workshop for union organizers as examples of media inaccuracies.

An employer is not required to fire an employee after 90 days, as news accounts have stated. The employer has 90 days to fix discrepancies, and the worker has three days after that to fill out another I-9 form with a new Social Security number. If it appears credible, employers must accept the new I-9, Ugarte said.

The ICE insert in the SSA letter will terrify employers, he predicted, but the rule does not create any new information sharing between the SSA and other governmental agencies. The SSA is actually prohibited by law from sharing private data with any other governmental agencies.

There are also no automatic fines assessed to employers, as news accounts have implied. ICE will only levy fines if it raids employers and finds that they did not address no-match discrepancies. It is unlikely that the DHS will be able to enforce the regulations; in announcing them, Chertoff said the agency would rely largely on self-policing.

Even if this is the case, organizers fear that the DHS’s no-match regulation will provide employers with another tool to squelch immigrant workers’ rights. Comprehensive immigration reform is still needed to reconcile employers’ demands for workers, immigrants’ needs for employment, and US immigration policy.*

The tragic tale of Tamesha Tobie

At first, police believed it was a terrible, self-inflicted mishap.

It happened April 15, just after the funeral held for a San Francisco man who’d succumbed to diabetes. Mourners were gathered in the Western Addition home of Tamesha Tobie’s grandmother, Edna Tobie. Tamesha, a 14-year-old first-year high schooler in town from Stockton for the funeral, was hanging out with two teenage boys, her cousins, in a bedroom — a room where, it turns out, another family member had stashed a powerful .357 Magnum revolver. Suddenly, the house filled with the sound of the gun’s pop.

Tobie’s aunt was cooking in the kitchen. She rushed to find out what was going on. The two boys met her in the hallway and told her there was a gun; she found Tobie on the bed, not moving. Nearby lay the pistol, with five live rounds and a shell still visible in the cylinder under the hammer.

The family dialed 911, and soon the area was packed with uniforms. Paramedics arrived with the police, as did a media flack who expected reporters, a crisis response team from the health department, the local medical examiner, and Sup. Ross Mirkarimi, whose district includes Edna Tobie’s Oak Street home.

"These are vivid experiences you don’t lose," Mirkarimi said. "The gut-wrenching part is that it was a young girl."

Fox, CBS, the Associated Press, and the San Francisco Chronicle all reported what the cops told them: Tamesha Tobie had accidentally shot herself with the gun.

But it turns out that wasn’t true. In fact, according to an autopsy completed by the medical examiner June 1, Tobie didn’t pull the trigger.

Her death has become another in a long list of unsolved homicides in San Francisco — and another sign that gun violence, both accidental and intentional, is raging out of control.

THE COPS DON’T KNOW


Months after the killing, the San Francisco Police Department didn’t seem aware that Tobie’s death was anything but an accident.

When we contacted the SFPD’s press office early in September, the staffers weren’t aware that her death had been ruled a homicide, nor was Lt. John Murphy, head of the homicide unit. Department spokesperson Sgt. Neville Gittens even requested that the Guardian fax him a copy of the report.

Now the SFPD acknowledges that Tobie was a homicide victim. "We believe it was done at the hands of someone else," Gittens said a week after receiving the report.

A homicide inspector assigned to the case said he learned of the medical examiner’s final report two weeks ago but explained that he’d already regarded Tobie’s death as suspicious.

Inspector Mike Johnson said he thinks one of the two cousins in the room with Tobie fired the weapon. Police have also concluded that the gun was used in an unrelated San Francisco homicide a few months prior by another young family member before being hidden in the home of Tobie’s grandmother.

Nobody has been arrested in that case either. Despite the fact that this gun has now been used to kill at least two people, Johnson conceded that not enough evidence exists to make an arrest in the first murder, even though a suspect has been identified — an exasperating fact for a city already near last year’s total of 85 murders.

If nothing else, the gun’s owner could possibly be guilty of negligence or child endangerment — but no charges are pending.

"The capacity of government not to do something about this at the pace that it is rocketing is what is absolutely alarming," said Mirkarimi, who’s pushed the Mayor’s Office of Criminal Justice to provide better data on violent crime in the city, "because it’s not going to abate itself…. The way that the number is traveling out of the reach of the Police Department and the district attorney — I think we’re going to need to send red flares up, SOS."

DEADLY HORSEPLAY


The Tamesha Tobie case is tricky; there were only three people in the room, and one is dead. The boy who police believe accidentally ended Tobie’s life won’t confess, Johnson said. Some relatives dispute the police’s view that one of the boys mistakenly fired the weapon and instead believe the story the pair have stuck to so far — that the gun fired on its own from the bed as they horsed around, the bullet smashing through the right rear of Tobie’s jaw.

"Obviously the one boy who did it doesn’t want to say anything to us," Johnson said. "And the other boy is somewhat traumatized, and his parents are worried about any possible criminal charges against him for associating with the first boy. So right now we’re trying to corroborate the stories and what happened through other people who were in the house…. It’s kind of a sensitive thing at this point."

But either way, Tamisha Tobie is the ultimate victim of gun violence, and while her death likely wasn’t intentional, it’s joined the city’s steadily climbing homicide rate nonetheless.

Attempts to reach Tobie’s family for comment were unsuccessful.

Statewide in 2004, 10 kids were killed after being accidentally shot either by themselves or by someone else, according to figures maintained by the federal Centers for Disease Control and Prevention. More recent figures won’t be available until later this year. But according to media accounts and calls to local police jurisdictions, over the past 12 months, three children died similarly just in the Bay Area.

In June a five-year-old boy in Oakland shot himself while playing with a relative’s gun, and a 28-year-old man was arrested for child endangerment — in notably less time than it took San Francisco to complete Tobie’s autopsy.

Just days after Tobie was killed, an 18-year-old girl accidentally shot a younger male teen in the city of Richmond with a revolver he’d found in the home where his death occurred. Last November a 16-year-old boy in Contra Costa County was killed after a friend accidentally shot him in the chest while playing with a .22-caliber revolver. Several other accidents occurred during 2006 in San Francisco and the East Bay, including one involving an Alameda toddler who that spring mistakenly shot his 20-year-old cousin with a .38 that belonged to a family friend.

The gun lobby complains that news stories depicting such deaths overstate the problem of accidents among kids and foster hysteria.

But Shawn Richard of the local nonprofit Brothers Against Guns has a response. The volume of deaths, he argues, isn’t the story.

"It could be a low number. It could be a high number," Richard said. "Regardless, it’s still ridiculous to deal with lives that are being taken by a gun."

Richard founded Brothers Against Guns after two of his siblings were shot to death in San Francisco during the 1990s. He joined the Mayor’s Office, District Attorney Kamala Harris, and the Legal Community Against Violence in drafting a batch of local antigun ordinances that passed the Board of Supervisors last month. One requires local firearms dealers to send inventories of their weapons to the police chief every six months, and another requires all handgun owners to disable their weapons with trigger locks.

Richard is also working with Assemblymember Mark Leno (D-San Francisco) to ban gun shows at the Cow Palace, which is located on state property near the Sunnydale housing project, where violent crimes are a frequent occurrence.

But would all of the antigun news releases in the world have saved Tobie? Homicide inspector Johnson wonders aloud whether they would.

"If the gun’s used in a homicide," Johnson said, "and it’s hidden in the house by children, who’s going to put a gun lock on it?"

A robust bowl of Vietnamese yum, served at the unassuming Hai Ky Mi Gia in the Tenderloin, this dish ($6.45) is basically an Asian mulligatawny, containing shredded chicken and pork, fish balls, delectable wontons, and strips of Spamlike pressed meat served over a bed of thick or thin egg noodles and doused with one of the most delicious chicken-based broths I’ve ever had the pleasure of slurping down. (Yes, I tipped the bowl.) Also available in an equally slurpable vit tìm version ($6.95), with a whole braised duck leg tossed into the bowl. Difficult to navigate with chopsticks but, I’m proud to tell you, entirely possible.

MADILLI AL PESTO


Mi dio, mi dio! Served at brand spanking new Italian stunner Farina Focaccia and Cuccina Italiano in the Mission, this is handkerchief pasta smothered in pesto ($15). What is handkerchief pasta? It’s basically one giant noodle — uncut, unedited, and layered gently on the plate. But to pasta lovers like me, it’s a dream pillow. The light, garlicky pesto laces each tender bite with a kick of heavenly spice. When it’s accompanied by Farina’s justly famous cappon magro vecchia Genova ($15) — chilled salad with halibut, lobster, mussels, shrimp, cauliflower, carrot, green bean, potato, beet, and boiled eggs — you’ll float off contentedly into the night.

SEAFOOD GAN ZAZANG


This one’s only for the truly hardy among us, but incredibly rewarding. Order this at Zazang Korean Noodle in the Western Addition and you’ll be served a bowl of curly yellow flour-based noodles, a side dish of pickled vegetables, raw onions, and gooey duck sauce, and another bowl — the main event — of black bean pasta sauce so dark it almost swallows the high-beam fluorescent light buzzing about the place. The sauce contains calamari, mussels, shrimp, and chunks of fish — and once the squid ink settles in with the black beans, the sauce evokes the flavor and texture of dark chocolate fudge. Mix it with the noodles, swallow a few mouthfuls, and you may never want to leave. Also of interest is the goo choo jap chae ($12.95) — clear yam noodles, stir-fried with bell pepper, onion, and juicy beef. Fair warning: each order is enough to stuff four.

GEBRATENE REHMEDAILLIONS IN ROTWEIN-PFLAUMENSOSSE MIT ROTKOHL UND SPÄTZLE


Purists will object, protesting that spaetzle reside more in the dumpling wing of the house of pasta, but, hey, I’m a rebel, and in German cuisine these doughy tidbits, or "little sparrows," serve much the same function as noodles. This dish ($18.50), from Suppenküche in Hayes Valley, is a heaping plateful of hearty venison medallions in a thick red wine and plum sauce, accompanied by a pile of savory red cabbage salad and a big scoop of buttery Knöpfle, or button spaetzle. After washing it all down with a giant glass of Köstritzer beer, you may feel yourself sinking through one of Suppenküche’s table-benches into pure Teutonic bliss. Arrive early, though — ever since the new Hayes Green opened nearby, this restaurant has been packed to the Germanic gills.

WHOLE ROAST CRAB WITH GARLIC NOODLES


Get that bib on — PPQ Dungeness Island in the Outer Richmond is about to soak you in garlic butter like you’ve never been soaked before. First of all, hurray for Dungeness crab season (already reaching full Alaskan swing and about to hit our fair shores in November.) Second, a fond how-do-you-do to PPQ’s prix fixe whole crab menu ($50 for two). Mouthwatering Imperial rolls and piquant shredded cabbage with chicken launch your 90-minute culinary journey, and fried bananas with ice cream bring you back around, but in the middle — oh, the middle: a steaming, full-size, whole roast crab drenched in thick butter sauce and spattered with chunks of garlic, served with a generous bowlful of PPQ’s renowned sticky garlic noodles, perfect for dipping into the creamy pool beneath the crab’s soon-to-be demolished shell.

TAGLIOLINI "PEPATI"


Hand-crafted thin, flat egg noodles in a blissful roasted tomato sauce with smoked bacon, thickly sliced jalapeños, butter, arugula, garlic, and peccorino and asana cheeses, topped with grated parmesan. Wow. This kicky, diet-busting wonder ($12), created at Aperto in Portrero Hill, rivals any similar North Beach concoction — even those available at one of my favorite restaurants of all time, L’Osteria del Forno. If you’re lucky enough to order this for lunch on a day when Aperto is serving its fabulous carrot-fennel soup, you may want to cancel your afternoon appointments, order a couple of glasses of sangiovese, and savor every mouthful. That’s what I did.
