Danny Glover, DCCC stand up for HANC

The Haight Ashbury Neighborhood Council (HANC) Recycling Center has gained some powerful allies in its ongoing fight against eviction.

A YouTube video posted over the weekend shows actor Danny Glover, a resident of the Haight, sitting in his car at the recycling center. If it were shut down, “I would be dismayed,” Glover tells a staff member. He also says, “It would be a tragedy. It would be a great loss to this city.” (Scroll down to watch.)

On Jan. 26, the Democratic County Central Committee (DCCC) voted in favor of a resolution calling for the HANC recycling center to stay at its location behind the Kezar Stadium in Golden Gate Park. The statement noted that “San Francisco is notoriously underserved by recycling centers,” adding that “people want to receive their California Redemption Value deposit, especially in this depressed economy, which can only be done at recycling centers.”
 
In recent weeks, Sup. Eric Mar told the Guardian he was strongly supportive of the recycling center’s continued operation in the park. He added that he planned to encourage Mayor Ed Lee to overturn the eviction.

The San Francisco Recreation & Park Commission voted in December 2010 to evict the recycling center from a paved lot in Golden Gate Park, where it has been operating for more than three decades. Since the center was originally on a quarterly lease, it was given 90 days notice — but HANC’s lawyer contends that it could legally occupy the property till June.

The eviction, supported by former Mayor Gavin Newsom and a commission composed of his appointees, was widely viewed by recycling center supporters as a form of political payback. HANC, a progressive organization that was at odds with the Newsom administration on a variety of issues, was particularly outspoken against the sit/lie ordinance, which Newsom placed on the ballot.

A neighborhood group, the Inner Sunset Park Neighbors, also supported the ouster of HANC, citing quality-of-life issues such as aggressive panhandling and public safety concerns that the group believes to be linked to recycling center patrons. Rec & Park plans to use the lot for a community garden, at a cost of $250,000.

EDITORIAL A piece of simple, logical legislation that would protect San Francisco consumers, public safety, and the environment appears headed for the desk of Mayor Ed Lee — and his signature would be the first clear sign that he’s not going to let powerful lobbyists (or the legacy of Gavin Newsom) guide his decisions.

The bill, by Sup. Ross Mirkarimi, would establish several secure places where people can drop off unused, unwanted, or expired pharmaceuticals for safe disposal. It seems so simple: every year, huge amounts of prescription meds are flushed down toilets or left around in medicine cabinets or drawers in the city. As much as one-third of all medicine purchased in the country is never used. The stuff that goes down the drain already has had a proven impact on aquatic life; the pills that never get thrown away are a hazard, particularly in households with small children.

But under current law, the only safe way to get rid of old meds is to return them to a pharmacy — and pay a fee. The cost of returning old drugs is enough of a deterrent that most consumers don’t bother.

If you have used motor oil in California, you can drop off and recycle it free. Many hardware stores recycle old batteries, light bulbs, and paint. Computer makers have to pay for recycling their products. Why can’t the city mandate the same rules for medication?

The easy answer: because it would cost about $200,000 a year to set up drop-off sites in drug stores and police stations — and the pharmaceutical industry doesn’t want to pay.

It’s a trivial amount of money, a fraction of what the industry spends on lobbying. In fact, with Big Pharma lobbyists from Washington and Sacramento crawling all over City Hall to block the Mirkarimi bill, it’s possible that the drug companies have already spent more fighting the legislation than it would cost to implement it.

The bill would charge companies that sell pharmaceuticals in the city a very modest fee to pay for the drop-off program. Similar programs in other places (San Mateo County, Washington State) have been highly successful — but nobody yet has asked the companies that make billions of dollars selling these products to underwrite the cost. San Francisco would be the first.

The San Francisco Chamber of Commerce has been fighting hard against the measure, claiming it would discourage biotech firms from investing in the city. That’s a huge stretch, but the chamber’s lobbying had an impact. When the measure came up at the end of 2010, four supervisors — Sean Elsbernd, Carmen Chu, Michela Alioto-Pier, and Bevan Dufty — voted with the Chamber and Big Pharma. So the bill would not have survived a Newsom veto.

But thanks to the oddities of scheduling, the legislation comes up for second reading Jan. 25, giving the new board a chance to weigh in. That will be a test for the new supervisors, but Mirkarimi is confident he’s got the six votes to give the measure final approval.

Then it goes to Lee. And if he can stand up to the chamber and the misinformation campaign from Big Pharma and sign the measure, he’ll not only help San Francisco take a national stand on an important consumer and environmental issue, he’ll also demonstrate that he’s not going to fall in line the way Newsom did every time downtown calls.

Lee should stop the recycling eviction

EDITORIAL Mayor Ed Lee needs to demonstrate, as we noted last week, that he’s making a clean break from the politics and policies of the Newsom administration — and there are things he can do immediately to reassure San Franciscans that he’s going to offer more than another 11 months of a failed administration.

He can start by calling off the eviction of the Haight Ashbury Neighborhood Recycling Center.

The move by Newsom to evict the recycling center, on the edge of Golden Gate Park, was part of his administration’s war on the poor. It made no sense from a financial or environmental perspective. The center, which pays rent to the city, would be replaced by a community garden, which would pay nothing. The center creates green jobs that pay a living wage; all the workers would be laid off under Newsom’s plan. The center also operates a native plant nursery and provides a drop-off recycling site for local businesses.

A community garden makes only limited sense in a shady area that gets fog most of the year.

The only reason Newsom was determined to get rid of the place is that low-income people who collect bottles and cans around the city (an environmentally positive activity, by the way) come by the center to drop them off and pick up a little cash. Some of the wealthier residents of the Haight don’t like poor people wandering through their neighborhood. It’s class warfare, declared by the Newsom administration — and Lee, who got his start as a poverty lawyer, doesn’t have to tolerate it.

Lee should direct the Recreation and Parks Department to cease the eviction proceedings and negotiate a long-term lease for the Frederick Street site.

It seems like a small item in the long list of issues the new mayor will have to deal with — but the HANC recycling center has strong symbolic importance. Ending the eviction and allowing the center to stay would be a sign that Lee intends to be a mayor who is willing to work with the progressives and that he’s not going to try to solve all the city’s problems by blaming, harassing, and criminalizing people who are barely surviving in San Francisco.

The new mayor could take another simple step toward broad credibility by opening up his office — to the public and the press. Under Newsom, Room 200 was an unfriendly place to outsiders, and often the news media were treated as enemies. Lee should start holding regular press conferences — not just stage-managed events designed to showcase one issue, but broad-ranging, open sessions where reporters can ask questions about anything his administration is doing. And he ought to direct his press office to make compliance with the Sunshine Ordinance a priority.

For starters, he could release whatever proposed budget cuts Newsom left behind. It’s hard to believe the former mayor just turned them over to Lee without a list of things that were on the chopping block. The sooner the public sees where the previous administration was going, the sooner we can all determine what, if anything, Lee will do differently.

They have issues: Members of the new Board speak

Board President David Chiu touched off a broad political discussion in recent weeks with his statement that officials were elected “not to take positions, but to get things done.” Delivered just before his reelection as Board President with the solid backing of the board’s moderate faction, Chiu’s comment has been viewed in light of City Hall’s shifting political dynamic, a subject the Guardian explores in a Jan. 19 cover story. Politics aside, Chiu’s statement also begs the question: Just what do members of the board hope to get done, and how do they propose to accomplish the items on their agenda?
Last week, Guardian reporters tracked down every member of the board to find out. We asked, what are your top priorities? And how do you plan to achieve them? Some spoke with us for 25 minutes, and others spoke for just 5 minutes, but the result offers some insight into what’s on their radar. Not surprisingly, getting the budget right was mentioned by virtually everyone as a top priority, but there are sharp differences in opinion in terms of how to do that. Several supervisors, particularly those in the moderate wing, mentioned ballooning pension and healthcare costs. Aiding small business also emerged as a priority shared by multiple board members.

District 1

Elected in 2008 to represent D1, Sup. Eric Mar has been named chair of the powerful Land Use & Economic Development Committee and vice chair of the City Operations and Neighborhood Services Committee.

Asked to name his top priorities, Mar said, “A humane budget that protects the safety net and services to the must vulnerable people in San Francisco is kind of the critical, top priority.”

It’s bound to be difficult, he added. “That’s why I wish it could have been a progressive that was chairing the budget process. Now, we have to work with Carmen Chu to ensure that it’s a fair, transparent process.”

A second issue hovering near the top of Mar’s agenda is lending a helping hand to the small businesses of the Richmond District. “There’s a lot of anxiety about the economic climate for small business. We’re trying to work closely with some of the merchant associations and come up with ideas on how the city government can be more supportive,” he said. Mar also spoke about the need to respond to the threat of big box stores, such as PetCo, that could move in and harm neighborhood merchants. “I’m worried about too many of the big box stores trying to come in with an urban strategy and saying that they’re different — but they sure have an unfair advantage,” he noted.

Programs and services for the senior population ranked high on his list. Mar noted that he’d been working with senior groups on how to respond to a budget analyst’s report showing a ballooning need for housing – especially affordable housing – for seniors. “It’s moving from the Baby Boom generation to the Senior Boomers, and I think the population, if I’m not mistaken, by 2020 it’s going up 50 percent,” he said. “It’s a huge booming population that I don’t think we’re ready to address.”

Addressing food security issues through the Food Security Task Force also ranked high on Mar’s list, and he noted that he’s been working with a coalition that includes UCSF and the Department of Public Health to study the problem. “We’ve had a number of strategy meetings already, but we’re trying to launch different efforts to create healthier food access in many of our lowest income neighborhoods,” Mar said.

Finally, Mar talked about issues relating to the park. “I do represent the district that has Golden Gate Park, so I’m often busy with efforts to preserve the park, prevent privatization, and ensure enjoyment for the many residents not just in the Richmond but throughout the city that enjoy the park.” Although it’s not technically in his district, Mar noted that he is very supportive of HANC Recycling Center – and plans to advocate on their behalf to Mayor Lee.

District 2

Elected to replace termed-out D2 Sup. Michela Alioto-Pier, Farrell has been named vice-chair of the Government Audits & Oversight Committee and a member of the Rules Committee. A native of D2, Farrell told the Guardian he believes his roots in the city and background as a venture capitalist would be an asset to the city’s legislative body. “I know at the last board, Carmen [Chu] was the only one who had any finance background,” he said. “To have someone come from the private sector with a business / finance background, I really do believe … adds to the dialogue and the discussion here at City Hall.”

Along those lines, Farrell said one of his top priorities is the budget. “I’m not on the budget and finance committee this time around, but given my background, I am going to play a role in that,” he said.

So what’s his plan for closing the budget deficit? In response, he alluded to slashing services. “In the past, there have been views that we as a city don’t provide enough services and we need to raise revenues to provide more, or the perspective that we first need to live within our means and then provide more services. Everyone’s going to disagree, but I’m in the latter camp,” he said. “I do believe we need to make some tough choices right now – whether it be head count, or whether it be looking at …pension reform. I do believe pension reform needs to be part of the dialogue. Unfortunately, it’s unsustainable.”

He also said he wanted to be part of “trying to create and focus on a framework for a long-term financial plan here in San Francisco.”

Secondly, Farrell discussed wanting to put together a “jobs bill.”

“Jobs is a big deal,” he said. “It’s something I want to focus on. There are only so many levers we can pull as a city. I think the biotech tax credits have spurred a lot of business down in Mission Bay.”

Next on Farrell’s agenda was quality-of-life issues, but rather than talk about enforcing San Francisco’s sit/lie ordinance – supported by political forces who organized under the banner of maintaining ‘quality-of-life’ – Farrell revealed that he is incensed about parking meter fines. “It is so strikingly unjust when you are 1 minute late to your parking meter and you have a $65 parking fine,” he said.

Farrell also mentioned development projects that would surely require time and attention. “CPMC is going to be a major dominant issue,” he said. He also mentioned Doyle Drive, and transitional age youth housing projects proposed in D2 – but as far as the housing project planned for the King Edward II Inn, which has generated some controversy among neighborhood groups, he didn’t take a strong position either way, saying he wanted to listen to all the stakeholders first.

Elected for a second two-year term as President of the Board, D3 Sup. David Chiu is rumored to be running in the mayor’s race, after he turned down former Mayor Gavin Newsom’s offer to appoint him as District Attorney. That offer was made after Kamala Harris won the state Attorney General’s race this fall. And when Chiu turned it down, former Mayor Gavin Newsom shocked just about everybody by appointing San Francisco Police Chief George Gascon, who is not opposed to the death penalty and was a longtime Republican before he recently registered as a Democrat, instead.

A temporary member of the Board’s Budget acommittee, Chiu is also a permanent member of the Board’s Government Audits & Oversight Committee.

Asked about his top priorities, Chiu spoke first and foremost about  “ensuring that we have a budget that works for all San Franciscans, particularly the most vulnerable.” He also said he wanted to see a different kind of budget process: “It is my hope that we do not engage in the typical, Kabuki-style budget process of years past under the last couple of mayors, where the mayor keeps under wraps for many months exactly what the thinking is on the budget, gives us something on June 1 for which we have only a couple of weeks to analyze, and then engage in the tired back-and-forth of debates in the past.” Chiu also spoke about tackling “looming pension and health care costs.”

Another priority, he said, was “Ensuring that our neighborhoods continue to remain the distinctive urban villages that they are, and protecting neighborhood character,” a goal that relates to “development, … historic preservation, [and] what we do around vacant commercial corridors.”

*Immigrant rights also made his top-five list. “I was very sad that last November we didn’t prevail in allowing all parents to have a right and a voice in school board elections,” he said, referencing ballot measure Proposition D which appeared on the November 2010 ballot. “I think we are going to reengage in discussion around Sanctuary City, another topic I have discussed twice already with Mayor Lee.”

Another issue for Chiu was  “ensuring again that hopefully San Francisco continues to remain an economically diverse city, and not just a city for the very wealthy.” He spoke about reforming city contracts: “In particular, dealing with the fact that in many areas, 70 to 80 percent of city contracts are awarded to non-San Francisco businesses. … I think there is more significant reform that needs to happen in our city contracting process.” Another economic-diversity measure, he said, was tax policy, “particularly around ensuring that our business tax is incenting the type of economic growth that we want.”

Finally, Chiu spoke about “Creating a transit-first city. This is not just about making sure MUNI is more reliable and has stable funding, but ensuring that we’re taking steps to reach a 2020 goal of 20 percent cycling in the city. Earlier this week I called for our transit agencies to look at pedestrian safety, because we are spending close to $300 million a year to deal with pedestrian deaths and injuries.”

Chiu has just named Sup. Carmen Chu as chair of the powerful Board and Finance Committee. And Chu, who worked as a budget analyst for Newsom’s administration, says the budget, core services, employment and the economy are her top priorities.

“My hope is that this year the budget is going to be a very collaborative and open process,” Chu said.

Chu believes workers benefits will be a central part of the budget-balancing debate.
“Any conversation about the long-term future of San Francisco’s budget has to look at the reality of where the bulk of our spending is,” she said.

Chu noted that the budget debate will have to take the state budget into account.
“At the end of the day, we need to take into account the context of the state budget, in terms of new cuts and taxes, because anything we do will be on top of the state level.

“We need to ask who do these measures really impact,” she added, noting that there were attempts to put revenue measures on the ballot last year.

With only two years left to serve on the Board, D5 Sup. Ross Mirkarimi has been named chair of the Board’s Public Safety Committee and vice-chair of the Budget and Finance Committee.

“One of my top priorities is building on and strengthening the work that I’ve already done and that Avalos is doing on mandatory local hire and First Source programs,” Mirkarimi said. He also spoke about “strengthening reentry programs for those coming out of the criminal justice system, because we still have an enormously high recidivism rate.”

The budget also ranked high on Mirkarimi’s list, and he stressed the need for “doing surgical operations on our budget to make sure that services for the vulnerable are retained, and looking for other ways to generate revenue beyond the debate of what’s going on the ballot.

“For instance, I helped lead the charge for the America’s Cup, and while the pay-off from that won’t be realized for years, the deal still needs to be massaged. What we have now is an embryonic deal that still needs to be watched.”

Mirkarimi mentioned safeguarding the city against privatization, saying one of his priorities was “retooling our budget priorities to stop the escalating practice of privatizing city services.”

 He spoke about “ongoing work citywide to make mixed-use commercial and residential infrastructure improvements, which coincide with bicycle and pedestrian improvements.”

Finally, Mirkarimi said he wanted to focus on transportation issues. “As Chair of the Transportation Authority, if I even continue to be chair, to take the lead on signature transit projects and work with the M.T.A. to reverse service cuts.”

District 6

Elected to replace termed-out D6 Sup. Chris Daly, Kim has been named chair of the Rules Committee and a member of the Budget & Finance committee.

Kim believes that she will prove her progressive values through her work and she’s trying to take the current debate about her allegiances on the Board in her stride.

“The one thing I learned from serving on the School Board was to be really patient,” Kim told me, when our conversation turned to the issue of “progressive values.”

“I didn’t want to be President of the School Board for the first few years, because I loved pushing the envelope,” Kim added, noting that as Board President David Chiu is in the often-unenviable position of chief negotiator between the Board and the Mayor.

But with Ed Lee’s appointment as interim mayor, Kim is excited about the coming year.
“There are a lot of new opportunities, a different set of players, and it’s going to be very interesting to learn how to traverse this particular scene.”

Kim is kicking off her first term on the Board with two pieces of legislation. The first seeks to address bedbug infestations. “Particularly around enforcement, including private landlords,” Kim said, noting that there have also been bedbug problems in Housing Authority properties.

Her second immediate goal is to look at pedestrian safety, a big deal in D6, which is traversed by freeways with off-ramps leading into residential zones.
“Pedestrian safety is a unifying issue for my district, particularly for all the seniors,” Kim said, citing traffic calming, speed limit enforcement and increased pedestrian traffic, as possible approaches.

Beyond those immediate goals, Kim plans to focus on jobs, economic development and small businesses in the coming year. “What can we do to create jobs and help small businesses? That is my focus, not from a tax reduction point of view, but how can we consolidate the permitting and fees process, because small businesses are a source of local jobs.”

Kim plans to help the Mayor’s Office implement Sup. John Avalos’ local hire legislation, which interim Mayor Ed Lee supports, unlike his predecessor Mayor Gavin Newsom.

“Everyone has always liked the idea of local hire, but without any teeth, it can’t be enforced,” Kim observed. “It’s heartbreaking that young people graduate out of San Francisco Unified School District and there’s been not much more than retail jobs available.”

She noted that jobs, land use and the budget are the three overarching items on this year’s agenda. “I’m a big believer in revenue generation, but government has to come half-way by being able to articulate how it will benefit people and being able to show that it’s more than just altruistic. I think we have to figure out that balance in promoting new measures. That’s why it’s important to be strong on neighborhood and community issues, so that folks feel like government is listening and helping them. I don’t think it’s a huge ask to be responsive to that.”

Kim said she hoped the new mayor would put out a new revenue measure, enforce local hire, and implement Sup. David Campos’ legislation to ensure due process for immigrant youth.

“I think Ed can take a lot of the goodwill and unanimous support,” Kim said. “We’ve never had a mayor without an election, campaigns, and a track record. Usually mayors come in with a group of dissenters. But he is in a very unique position to do three things that are very challenging to do. I hope raising revenues is one of those three. As a big supporter of local hire, I think it helps having a mayor that is committed to implement it. And I’m hoping that Ed will implement due process for youth. For me, it’s a no brainer and Ed’s background as a former attorney  for Asian Law Caucus is a good match. Many members of my family came to the U.S. as undocumented youth, so this is very personal. Kids get picked up for no reason and misidentified. People confuse Campos and Avalos, so imagine what happens to immigrant youth.”

With two years left to serve on the Board, D7 Sup. Sean Elsbernd has been named vice-chair of the Rules Committee and a member of the City Operations & Neighborhood Services Committee. He was congratulated by Chinatown powerbroker Rose Pak immediately after the Board voted 11-0 to nominated former City Administrator Ed Lee as interim mayor, and during Lee’s swearing-in, former Mayor Willie Brown praised Elsbernd for nominating Lee for the job.

And at the Board’s Jan. 11 meeting before the supervisors voted for Lee, Elsbernd signaled that city workers’ retirement and health benefits will be at the center of the fight to balance the budget in the coming year.

Elsbernd noted that in past years, he was accused of exaggerating the negative impacts that city employees’ benefits have on the city’s budget. “But rather than being inflated, they were deflated,” Elsbernd said, noting that benefits will soon consume 18.14 percent of payroll and will account for 26 percent in three years. “Does the budget deficit include this amount?” he asked.

And at the afterparty that followed Lee’s swearing in, Public Defender Jeff Adachi, who caused a furor last fall when he launched Measure B, which sought to reform workers’ benefits packages, told the Guardian he is not one to give up lightly. “We learned a lot from that,” Adachi said. “This is still the huge elephant in City Hall. The city’s pension liability just went up another 1 percent, which is another $30 million.”

As for priorities, Elsbernd broke it down into district, city, and regional issues. In D7, “Hands-down, without question the biggest issue … is Parkmerced,” he said, starting with understanding and managing the environmental approval process. If it gets approved, he said his top concerns was that “the tenant issue. And the overriding concern of if they sell, which I think we all think is going to happen in the near-term – do those guarantees go along with the land?”

Also related to Parkmerced was planning for the traffic conditions that the development could potentially create, which Elsbernd dubbed a “huge 19th Avenue issue.”

Citywide, Elsbernd’s top priorities included enforcing Proposition G – the voter-approved measure that requires MUNI drivers to engage in collective bargaining – and tackling pension and healthcare costs. He spoke about “making sure that MTA budget that comes to us this summer is responsive” to Prop G.

As for pension and healthcare, Elsbernd said, “I’ve already spent a good deal of time with labor talking about it, and will continue to do that.” But he declined to give further details. Asked if a revenue-generating measure could be part of the solution to that problem, Elsbernd said, “I’m not saying no to anything right now.”

On a regional level, Elsbernd’s priority was to help CalTrain deal with its crippling financial problem. He’s served on that board for the last four years. “The financial situation at CalTrain – it is without question the forgotten stepchild of Bay Area transit, and the budget is going to be hugely challenging,” he said. “I think they’ll survive, but I think they’re going to see massive reductions in services.”

Sup. Scott Wiener
District 8

Elected in November 2010 to replace termed-out D8 Sup. Bevan, Wiener has been named a temporary member of the Board’s Budget and Finance Committee and a permanent member of the Land Use and Economic Development Committee.

“Transportation is a top priority,” Wiener said. ‘That includes working with the M.T.A. to get more cabs on the street, and making sure that the M.T.A. collectively bargains effectively with its new powers, under Prop. G.”

“I’m also going to be focusing on public safety, including work around graffiti enforcement, though I’m not prepared to go public yet about what I’ll be thinking,” he said.

“Regulating nightlife and entertainment is another top priority,” Wiener continued. “I want to make sure that what we do is very thoughtful in terms of understanding the economic impacts, in terms of jobs and tax  revenues, that this segment has. With some of the unfortunate incidents that have happened, it’s really important before we jump to conclusions that we figure out what happened and why. Was it something the club did inappropriately, or was it just a fluke? That way, we can avoid making drastic changes across the board. I think we have been very reactive to some nightclub issues. I want us to be more thoughtful in taking all the factors into consideration.”

“Even if we put a revenue measure on the June or November ballot, we’d need a two-thirds majority, so realistically, it’s hard to envision successfully securing significant revenue measure before November 2012,” Wiener added. “And once you adopt a revenue measure, it takes time to implement it and revenue to come in, so it’s hard to see where we’ll get revenue that will impact the 2012 fiscal year. In the short term, for fiscal year 2011/2012, the horse is out of the barn”

“As for pension stuff, I’m going to be very engaged in that process and hopefully we will move to further rein in pension and retirement healthcare costs.”

Sup. David Campos
District 9

Elected in 2008, D9 Sup. David Campos has been named chair of the Board’s Government Audit & Oversight Committee and a member of the Public Safety Committee. And, ever since he declared that the progressive majority on the Board no longer exists, in the wake of the Board’s 11-0 vote for Mayor Ed Lee, Campos has found his words being used by the mainstream media as alleged evidence that the entire progressive movement is dead in San Francisco.

“They are trying to twist my words and make me into the bogey man,” Campos said, noting that his words were not a statement of defeat but a wake-up call.

“The progressive movement is very much alive,” Campos said. “The key here is that if you speak your truth, they’ll go after you, even if you do it in a respectful way. I didn’t lose my temper or go after anybody, but they are trying to make me into the next Chris Daly.”

Campos said his overarching goal this year is to keep advancing a good government agenda.

“This means not just making sure that good public policy is being pursued, but also that we do so with as much openness and transparency as possible,” he said.

As a member of the Board’s Public Safety Committee, Campos says he will focus on making sure that we have “as much community policing as possible.

He plans to focus on improving public transportation, noting that a lot of folks in his district use public transit.

And he’d like to see interim mayor Ed Lee implement the due process legislation that Campos sponsored and the former Board passed with a veto-proof majority in 2009, but Mayor Gavin Newsom refused to implement. Campos’ legislation sought to ensure that immigrant youth get their day in court before being referred to the federal immigration authorities for possible deportation, and Newsom’s refusal to implement it, left hundreds of youth at risk of being deported, without first having the opportunity to establish their innocence in a juvenile court.
‘We met with Mayor Lee today,” Campos told the Guardian Jan. 18. “And we asked him to move this forward as quickly as possible. He committed to do that and said he wants to get more informed, but I’m confident he will move this forward.”

Campos also said he’ll be focusing on issues around workers’ rights and health care.
“I want to make sure we keep making progress on those fronts,” Campos said.

“It’s been a rough couple of days,” Campos continued, circling back to the beating the press gave him for his “progressive” remarks.“But I got to keep moving, doing my work, calling it as a I see it, doing what’s right, and doing it in a respectful way. The truth is that if you talk about the progressive movement and what we have achieved, which includes universal healthcare and local hire in the last few years, you are likely to become a target.”

District 10

Elected to replace termed-out D10 Sup. Sophie Maxwell, Cohen has been named chair of the City & School District committee, vice chair of the Land Use and Economic Development Committee and vice chair of the Public Safety Committee.

Cohen says her top priorities are public safety, jobs, open space, which she campaigned on, as well as creating community benefits districts and putting an end to illegal dumping.

“I feel good about the votes I cast for Ed Lee as interim mayor and David Chiu as Board President. We need to partner on the implementation of local hire, and those alliances can help folks in my district, including Visitation Valley.”

“I was touched by Sup. David Campos words about the progressive majority on the Board,” she added. “I thought they were thoughtful.”

Much like Kim, Cohen believes her legislative actions will show where her values lie.
“I’d like to see a community benefits district on San Bruno and Third Street because those are two separate corridors that could use help,” Cohen said. 

She pointed to legislation that former D10 Sup. Sophie Maxwell introduced in November 2010, authorizing the Department of Public Works to expend a $350,000 grant from the Solid Waste Disposal Clean-Up Site trust fund to clean up 25 chronic illegal dumping sites.
“All the sites are on public property and are located in the southeast part of the city, in my district,” Cohen said, noting that the city receives over 16,000 reports of illegal dumping a year and spends over $2 million in cleaning them up.

District 11

Sup. John Avalos, who chaired the Budget committee last year and has just been named Chair of the Board’s City Operations and Neighborhood Services Committee, said his top priorities were implementing local hire, improving Muni and Balboa Park BART station, building affordable housing at Balboa, and improving city and neighborhood services.

“And despite not being budget chair, I’ll make sure we have the best budget we can,” Avalos added, noting that he plans to talk to labor and community based organizations about ways to increase city revenues. “But it’s hard, given that we need a two-thirds majority to pass stuff on the ballot,” he said.

Last year, Avalos helped put two measures on the ballot to increase revenues. Prop. J sought to close loopholes in the city’s current hotel tax, and asked visitors to pay a slightly higher hotel tax (about $3 a night) for three years. Prop. N, the real property transfer tax, h slightly increased the tax charged by the city on the sale of property worth more than $5 million.

Prop. J secured only 45.5 percent of the vote, thereby failing to win the necessary two-thirds majority. But it fared better than Prop. K, the competing hotel tax that Newsom put on the ballot at the behest of large hotel corporations and that only won 38.5 percent of the vote. Prop. K also sought to close loopholes in the hotel tax, but didn’t include a tax increase, meaning it would have contributed millions less than Prop. J.

But Prop. N did pass. “And that should raise $45 million,” Avalos said. “So, I’ve always had my sights set on raising revenue, but making cuts is inevitable.”

Editorial: New Mayor Ed Lee should stop the recycling eviction

Mayor Ed Lee needs to demonstrate, as we noted in last week’s editorial, that he’s making a clean break from the politics and policies of the Newsom administration and there are things he can do immediately to reassure San Franciscans that he’s going to offer more than another 11 months of a failed administration.

He can start by calling off the eviction of the Haight Ashbury Neighborhood Recycling Center.

The move by Newsom to evict the recycling center, on the edge of Golden Gate Park, was part of his administration’s war on the poor. It made no sense from a financial or environmental perspective. The center, which pays rent to the city, would be replaced by a community garden, which would pay nothing. The center creates green jobs that pay a living wage; all the workers would be laid off under Newsom’s plan. The center also operates a native plant nursery and provides a drop-off recycling site for local businesses.

A community garden makes only limited sense in a shady area that gets fog most of the year.

The only reason Newsom was determined to get rid of the place is that low-income people who collect bottles and cans around the city (an environmentally positive activity, by the way) come by the center to drop them off and pick up a little cash. Some of the wealthier residents of the Haight don’t like poor people wandering through their neighborhood. It’s class warfare, declared by the Newsom administration and Lee, who got his start as a poverty lawyer, doesn’t have to tolerate it.

Lee should direct the Recreation and Parks Department to cease the eviction proceedings and negotiate a long-term lease for the Frederick Street site.

It seems like a small item in the long list of issues the new mayor will have to deal with but the HANC recycling center has strong symbolic importance. Ending the eviction and allowing the center to stay would be a sign that Lee intends to be a mayor who is willing to work with the progressives and that he’s not going to try to solve all the city’s problems by blaming, harassing, and criminalizing people who are barely surviving in San Francisco.

The new mayor could take another simple step toward broad credibility by opening up his office to the public and the press. Under Newsom, Room 200 was an unfriendly place to outsiders, and often the news media were treated as enemies. Lee should start holding regular press conferences not just stage-managed events designed to showcase one issue, but broad-ranging, open sessions where reporters can ask questions about anything his administration is doing. And he ought to direct his press office to make compliance with the Sunshine Ordinance a priority.

For starters, he could release whatever proposed budget cuts Newsom left behind. It’s hard to believe the former mayor just turned them over to Lee without a list of things that were on the chopping block. The sooner the public sees where the previous administration was going, the sooner we can all determine what, if anything, Lee will do differently.  

Will the “real” progressives please stand up?

Before Ed Lee was unanimously appointed interim mayor at the Jan. 11 Board of Supervisors meeting, Sup. David Campos delivered a speech about the progressive movement in San Francisco.

“Progressives are no longer in control of this Board of Supervisors,” Campos noted. “We have a president of the Board of Supervisors who was elected without a clear progressive majority, and who was elected with a clear backing of the moderate block of supervisors.”

Speaking to the notion that supervisors were not elected to take positions, but to get things done, an idea aired by Board President David Chiu, Campos demurred. “I don’t think it’s entirely accurate to say that none of us are elected to take certain positions,” he said.

“It’s important to get things done,” Campos continued. “But I don’t think getting things done is enough. We have to ask ourselves, what is it that we’re getting done? How is it that we’re getting things done? And for whom is it that we’re doing what we’re doing?”

Would things be done in the interests of the people, Campos wanted to know, “or the downtown corporate interests?”

Would things be done in a transparent way? “I hope we’re not getting things done behind closed doors,” Campos said.

Campos also took issue with the implication that “progressives cannot get things done.” He pointed to district elections, universal healthcare, domestic partner benefits, and police reform as accomplishments of the progressive community.

Despite Campos’ pronouncement that progressives were on the losing end, nearly every elected official who stood to speak throughout the course of the historic day uttered the P-word — including Lee himself.

“I was a progressive,” Lee said during his inaugural speech, “before progressive was a political faction in this town.” Lee pointed to his history of fighting for the rights of African Americans and Latinos, his move to establish a whistle-blower program, and his role in creating a recycling program for the city as evidence of his progressive credentials.

Supervisors Eric Mar, Ross Mirkarimi, and Chiu also touched on the issue of progressive politics in comments delivered before Lee was unanimously appointed. “Progressive politics needs to qualify its new definition,” Mirkarimi said, “which is more than just who we are by name or

by ethnicity or culture but by what we stand for.” Mirkarimi also spoke about the transition representing an opportunity to “inject a level of smart politics, not necessarily branded as a progressive or moderate or conservative, but smart politics that take us forward.”

Mar spoke about “our changing progressive movement,” and Board President David Chiu countered Campos’ charge that progressives had lost their control of the board, saying, “I do believe that the majority of this board shares progressive values.”

Chiu also said he believed that there is “a danger in an overly narrow definition of what is progressive.”

At this point, given so many different opinions and affiliations with the label, the very word “progressive” is starting to take on a confusing quality. Does this stem from a lack of a better term? Is it simply that many people with different sets of alliances and perspectives, sometimes at odds with one another, nonetheless identify as “progressives?”

Or is does this new, more complex version of “progressive” relate to the void left behind by two polarizing figures, who drew definitive battle lines between “progressives” and “moderates” by staking out furious opposition to each other? The transition of power in City Hall was marked not only by the introduction of new elected officials in the board chambers and Room 200, but by the departure of former Sup. Chris Daly and former Mayor Gavin Newsom, both towering white men known for relishing the limelight, delivering long-winded addresses, and waging fierce battles against their enemies.

If those elected officials once viewed as the solidly progressive block – former Sup. Chris Daly and Sups. John Avalos, David Campos, Eric Mar, and Ross Mirkarimi – were swept out of power with this shift, as Campos suggested, their political label seems to have survived intact. Despite the approving nod of the board’s moderates and two business-friendly powerhouses who hold tremendous sway even if they don’t hold office, the city’s top two officials — Chiu and Lee — nonetheless seemed eager to be associated with “progressive” values.

Trash talk

The fate of the city’s mountains of garbage — 1,400 tons a day — will be decided some time in the next few months. Maybe.

Two competing proposals for hauling away the trash have been up for consideration since last spring. But the San Francisco Board of Supervisors still doesn’t seem to know which alternative is better, and the board still hasn’t scheduled a hearing on the issue.

Waste Management Inc. has the current contract and trucks waste to the Altamont landfill. Recology now wants to ship the garbage by rail three times as far away, to the company’s Ostrom Road landfill in Yuba County (“A Tale of Two Landfills,” 06/15/10).

David Assmann, deputy director of San Francisco’s Department of the Environment told the Guardian that his department asked for a hearing in October on its proposal to award the contract to Recology when the city’s contract at Altamont landfill expires in 2015.

“But that hearing request got delayed,” Assmann said. “With a new board, new committees, and maybe new chairs of committees coming in January, I’m not sure when the hearing will take place,” he added. “But I’d be surprised if it’s before Jan. 15.”

Sup. David Campos told the Guardian he still has many questions about the contract. “I don’t know if it’s the correct way to go at this point,” he said. “I’m trying to figure it out.”

That sentiment seems to be shared by Sups. John Avalos and Eric Mar, who took a road trip earlier this year to see both landfills. And some local waste management experts have suggested that Recology’s plan would be greener if the city barged its trash to Oakland, then loaded it onto trains, instead of driving it across the Bay Bridge.

Assmann acknowledged that the barging question keeps coming up, but said would be cost prohibitive since trash would have to be loaded and unloaded both sides of the bay. “It would be horrendously expensive, so it’s not a likely option unless folks want their rates to go up dramatically.”

And now Yuba County officials are rethinking how much to charge the city to dump it waste in their rural county’s backyard. Yuba County Supervisor Roger Abe told the Guardian his board has asked the county administrator to look into the process for raising disposal fees at Ostrom Road.

“We’re supposed to receive a report on that, plus parameters on what you can change,” Abe said, noting that fees at Ostrom Road were set at $4.40 per ton in 1996. “So it’s a 14-year-old fee. Clearly, the cost of living is a lot higher now. And when the landfill was established, it was only serving Yuba County. But now it’s being touted as a regional landfill, an approach that is depleting our county’s ability to dispose of its own trash. So if people outside the county are using our landfill, they should be paying more.”

But Assmann doesn’t think the rate hikes would torpedo the city’s plan. “Whichever one of the two landfills is chosen can always opt to raise fees. But that would also impact the fees of local residents, so it’s a self-inhibiting factor,” he said.

“And who knows the implications of Prop. 26 on this,” he continued, referring to the statewide proposition voters approved in November that requires a two-thirds supermajority vote in the state Legislature and at the ballot box in local communities to pass fees, levies, charges, and tax revenue allocations that previously could be enacted with a simple majority vote.

“But even if the fees double in Yuba County, they’ll still be less expensive that at Altamont,” he said. “So our recommendation is to go forward with the Ostrom Road landfill proposal.”

Abe agreed that Prop. 26 could have an impact on the fee-raising process. “But I find it difficult to believe that Yuba County would have a problem raising fees on out of town garbage,” he said. “If I had a choice, I’d say no to Recology. But if it’s coming anyway, I know that $4.40 per ton is not going to be sufficient compensation — and this county is desperate for funds.”

DoE director Melanie Nutter has claimed the Recology contract is environmentally friendlier and could save ratepayers $125 million over the life of the contract. “This is a good deal for San Francisco and for the environment,” Nutter stated when DoE was pushing for a board hearing in October. “Ostrom Road is a state-of-the-art facility that employs industry best practices, and the price is dramatically lower than the competition. This will help us maintain reasonable refuse collection costs as we move toward zero waste.”

The landfill disposal contract is for 5 million tons or 10 years, whichever comes first. DoE predicts that this amount will decrease in the coming years because of prior success in waste prevention, recycling, and composting programs. San Francisco already recycles 77 percent of its waste stream, the highest diversion rate of any city nationwide.

But Abe notes that Waste Management proposes to use methane generated from trash disposed at its Altamont landfill to power its liquid natural gas trucks. “I can’t see how using trains would be greener,” he said.

Recology spokesperson Adam Alberti has told the Guardian that Recology’s waste disposal contract was environmentally superior, in part because San Francisco has mandatory composting legislation that reduces the amount of decomposing organics, a major source of greenhouse gas emissions, being sent to landfills. But Irene Creps, who has homes in San Francisco and Yuba County, pointed out that not all municipalities disposing trash at Ostrom Road have mandatory composting laws, which means the landfill will continue to generate methane. “A lot of places around here only have a black bin,” Creps said.

Meanwhile, Waste Management has threatened legal action if San Francisco awards the contract to Recology, alleging that Recology’s bid was procured under flawed and potentially unlawful application of administrative rules. In a Nov. 9, 2010 letter, WM’s Bay Area Vice President Barry Skolnick urged San Francisco’s Board of Supervisors to “reject the award to Recology and avoid entering into a high-priced 10-year contract that is not even necessary until 2015, at the earliest, and to apply the procurement process to all qualified bidders fairly and consistently, as the law requires.”

The local trash controversy continues as a grassroots movement to stop Recology from expanding at the Jungo Road Landfill in Humboldt County, Nev., won an interim round. At a Dec. 20 meeting, Humboldt County commissioners voted 4-1 to reject a proposed settlement agreement with Recology that would have allowed the landfill to continue.

Newsom’s homeless policy failure

I have no reson to dispute the figures in the Chron this morning showing that Mayor Newsom has moved 12,210 people off the streets of San Francisco, 6,692 of them placed into supportive housing and 5,518 shipped out of town with a free bus ticket. Randy Shaw, who has a city contract to run some of the hotels that Newsom is using for formerly homeless people, says Newsom has the “best record [on the issue] of any mayor in the United States”


And still the Chron laments, there are still homeless people on the streets:


Yet many of San Francisco’s neighborhoods remain plagued with panhandlers, and residents and tourists alike complain of feeling scared or just plain disgusted.


Let me suggest one possible reason that there’s so much panhandling still going on: Even the formerly homeless who now have residential hotel rooms don’t have enough money to eat. That’s because Newsom’s signature “Care Not Cash” measure took money away from welfare payments and shifted it into housing. These days, general assistance pays just $59 a month. Try living on that. Even with food stamps (which don’t buy you meals if you don’t have a kitchen to cook in) the money the city pays out is too little. So people beg for more.


Yes, there are people who panhandle to buy money for drink and drugs. Reality check here: People — homeless or otherwise — are going to drink and do drugs in this city. Give them enough money in a monthly welfare check and they’ll use that instead of bothering the tourists. Panhandling isn’t easy or pleasant; people don’t do it because they want to. They do it because there’s no other way to get money.


(And please, my trolls: Don’t tell me that these folks should “get a job.” There are currently five unemployed people for every job opening in America, and it’s worse in San Francisco.)


Of course, now that Newsom has decided to evict the Haight Ashbury Neighborhood Council recycling center — a place where homeless people can legally make a little money without panhandling — the problem’s going to get worse.

In the grand scheme of things — the $400 million budget deficit, the pending selection of a new mayor, that sort of thing — the eviction of the Haight Ashbury Neighborhood Council Recycling Center doesn’t sound like an earthshaking issue. The San Francisco Chronicle’s C.W. Nevius (who is pretty much on the wrong side of everything these days) proclaimed last week that it was just a little neighborhood tiff, nothing to do with the soul of the city.

But it annoys me as much as anything that’s happened this fall — and it says a lot about the way Gavin Newsom governs San Francisco and explains why so many of us will be so happy when he leaves town.

Let me come right out and say it: the HANC eviction is class warfare. It’s not about the appropriate use of park land or the need for a community garden. It’s about the fact that the mayor doesn’t like poor people trundling through an upscale part of town with shopping carts full of recycling.

Let me quote what Rebecca Bowe wrote in a blog post at sfbg.com:

“In its current function, the HANC Recycling Center is empowering to many different kinds of people. Most aren’t homeless. Tough-as-nails Asian grandmas show up with bags full of cans that they can exchange for some extra spending money. Urban gardeners purchase native plants in hopes of pleasing native insects and birds. People on fixed incomes get a small financial boost by turning in recyclables.

“A small number of HANC Recycling Center patrons do sleep outside. In order to earn small amounts of cash for things like food, many of them have to go digging around in garbage cans, which is gross and humiliating. Why would someone paw through the garbage for hours, battling bees and germs, and then haul smelly bottles uphill in a shopping cart just to make a few bucks? My guess is that it’s to ward off desperation. They make their own work and they get to eat.”

Let me focus on that last sentence for a second. As my friend Tiny at Poor Magazine likes to point out, being poor or homeless is a lot of work. Collecting cans, cashing them in, finding a way to survive on that minuscule income … it’s not easy. It takes as much effort and as many hours as most traditional full-time occupations.

But Newsom doesn’t want poor people in his city. He doesn’t want anyone bothering the wealthy. And he doesn’t care about facts or the public sentiment.

City residents — those folks Nevius and Newsom love to celebrate — showed up in large numbers at the Recreation and Park Commission to oppose the closure. There’s no logic to it at all; the center pays rent and creates jobs. The community gardens will cost money — and in the shade (where the center is located), it will be hard to grow much produce.

But never mind: Newsom got what he wanted. A city that will spend millions in public money on yacht races while making life on the streets that much meaner. Good riddance, Gav.

EDITORIAL: No PG&E caretaker

We’ve made it clear in several editorials that the Board of Supervisors would be wasting a great opportunity and making a political mistake by choosing a mayor who vows to serve only as a “caretaker” and not run in the fall. A caretaker would lack the authority to make the significant changes that are needed at City Hall — and a vow not to run again would deprive the voters of the right to choose the next chief executive of the city. What would happen if the interim mayor did a great job? What if the so-called caretaker turns out to be the perfect person to continue on in the role?

But the real danger is that the board might choose a caretaker who not only continues the dangerous and divisive policies of Mayor Gavin Newsom, but sends the city in the wrong direction on the key decisions that will come up in the next 12 months.

The budget crisis is going to be the central concern of both the mayor and the supervisors, but there’s plenty more on the agenda. For example, the city will be moving next year to implement community choice aggregation — and since Pacific Gas and Electric Co. fought bitterly (and apparently illegally) to block Marin County from implementing a similar program, the next mayor needs to be prepared to fight PG&E vigorously. So anyone who lacks a record of taking on PG&E, or is weak on CCA, should be disqualified.

There will be a significant number of commission appointments coming up — and since the members of some panels serve at the mayor’s pleasure, and other commissioners often resign to give a new mayor the chance to put his or her own people in charge, the next mayor can remake city government on a larger level. We just saw, in the atrocious vote to evict the Haight Ashbury Neighborhood Council’s recycling center, how badly the Recreation and Park Commission functions. The Public Utilities Commission has dragged its feet on CCA. The Port and Airports Commission need new blood. And quite a few department heads should be replaced. Anyone serving in the Mayor’s Office next year needs to be willing to make those moves.

A bad caretaker could do real, lasting damage to the city; allowing PG&E to torpedo CCA would set progressive energy policy back a decade. Let’s remember, the progressives have six votes on the board; if they’re unable to agree on a longer-term replacement and want a caretaker, that person needs to have strong progressive, anti-PG&E credentials. Otherwise San Franciscans will be regretting the decision for a long time to come

Legal fight brewing over HANC Recycling Center eviction

The Haight Ashbury Neighborhood Council (HANC) Recycling Center, located at the Kezar Triangle in Golden Gate Park, received a 90-day eviction notice following a Dec. 2 Recreation and Park Commission meeting approving plans for a community garden in its current location. However, tenant lawyer Robert De Vries, who is representing HANC, submitted in a Dec. 2 letter to Rec & Park Commissioners that HANC could not legally be made to vacate until the end of June.

The eviction has prompted an outcry from progressive groups, environmental organizations, and other HANC supporters, who turned out en masse at the Dec. 2 meeting and voiced strong disapproval over the proposal. It now appears that the issue may wind up in court.

“HANC has no intention of vacating the premises any earlier than legally required,” De Vries wrote to Rec & Park Commissioners. “HANC is also not willing to allow disruptive construction work or other activities to go forward on the leased property while it is in possession.”

In an earlier memo to Rec & Park Commissioners, city staff proposed issuing HANC a 30-day eviction notice, which would have ousted the recycling center by the end of December. That timing was significant, because it would have occurred under the administration of Mayor Gavin Newsom, a proponent of the eviction, who will vacate office Jan. 8 to be sworn in as Lieutenant Governor. Citing advice from the San Francisco City Attorney, the memo noted that Rec & Park could proceed with a 30-day eviction without commission approval.

But that initial advice was erroneous, City Attorney spokesperson Matt Dorsey told the Guardian, because it did not take into account HANC’s quarterly rental payments. Since the organization pays rent once every 90 days, instead of once a month, it cannot be evicted with just 30 days notice, according to state law. Once it was informed of HANC’s quarterly payments (by city staff, not De Vries’ letter, Dorsey said), the City Attorney advised Rec & Park that it should extend the eviction notice to 90 days.

The extra 60 days doesn’t just buy HANC time, it gives them hope. Newsom will be in Sacramento by then, and it’s possible that he could be replaced with an interim mayor who’s sympathetic to their cause.

De Vries, however, contends that 90 days is still too soon, and that HANC can’t legally be evicted until June 30, 2011. HANC’s original five-year, fixed-term lease ended on June 30, 2001. Since then, it’s been paying rent to the city every 90 days. De Vries wrote that under state law, this arrangement means that “the lease is automatically renewed” for one year, and that it’s renewed annually since 2001. California courts have found that “a tenancy from year to year is created where a tenant holds over after the expiration of a former lease for one or more years and pays rent,” De Vries wrote in his letter. His analysis is based on his reading of California Civil Code Section 1945.

“I don’t really see any other interpretation, frankly,” De Vries told the Guardian. In his view, by issuing a 90-day notice, “they’re putting something into the statute that isn’t there.”

The City Attorney’s office rejects De Vries’ analysis, and insists that the eviction notice is legal. “The lease does not expire on June 30,” Dorsey said, “and Rec & Park delivered a proper notice of termination.”

If this dispute winds up in court, it’s possible that the question won’t be settled until June of 2011 anyhow.

Rec & Park trashes HANC Recycling Center

At yesterday’s Recreation & Park Commission meeting on Dec. 2, hundreds of San Francisco residents turned out to urge commissioners not to replace the Haight Ashbury Neighborhood Council (HANC) Recycling Center with a community garden. Their pleas fell on deaf ears.

It didn’t matter that a sunnier spot for a community garden had already been identified in the same area, with funding approved by the commission more than a year ago. It didn’t matter that thousands of people use the recycling center every month, and that the nonprofit bolsters community gardens throughout the city with donations and funding. It didn’t matter that we’re in a recession and there were jobs on the line. It didn’t matter that HANC pays rent to a city department facing a $12.5 million deficit, but the community garden would cost $250,000.

All that mattered in the end was that Rec & Park, and Mayor Gavin Newsom, wanted the HANC recycling center out. They thought removing it might discourage homeless people from sleeping in the park and hanging around the neighborhood. After nearly four hours of listening to residents urge them not to do it, the commissioners yawned and pushed the eject button. They unanimously voted in favor of the community garden. A 90-day eviction notice is expected to go out to HANC today.

The fight over HANC’s eviction has been described as a political battle between progressives and moderates, a showdown between heroes who stand up for public safety versus intimidating thugs and the lefties who enable them, and even a sequel to the sit /lie controversy. I think there’s an 800-pound gorilla sitting in the middle of this fight that no one wants to talk about: Class.

Community gardens are wonderfully empowering. I used to volunteer at one at a public housing complex in North Carolina. It was especially important for people who lived in that low-income community, since they benefited from nutritious produce that also lowered their grocery bills. Under the city’s plan for this new, gated community garden, 30 of the 40 garden plots will go to area residents. Given the affluence of that neighborhood, the garden beds will likely go to people who can afford organic groceries at Whole Foods without breaking into a sweat. For well-to-do San Franciscans, growing produce is not a means of survival — it’s about feeling good, and being green. By itself, there’s nothing wrong with that.

The problem is that it will be installed at the expense of a long-standing community resource that employs 10 people and lightens the load for hundreds of others during a recession, when people are truly struggling to get by. The Rec & Park Commission has essentially decided that this parcel of public space should be taken from a nonprofit that benefits people of all classes, and given to a small number of residents who’ve voiced complaints about “quality-of-life issues.”

In its current function, the HANC Recycling Center is empowering to many different kinds of people. Most aren’t homeless. Tough-as-nails Asian grandmas show up with bags full of cans that they can exchange for some extra spending money. Urban gardeners purchase native plants in hopes of pleasing native insects and birds. People on fixed incomes get a small financial boost by turning in recyclables.

A small number of the HANC Recycling Center patrons do sleep outside. In order to earn small amounts of cash for things like food, many of them have to go digging around in garbage cans, which is gross and humiliating. Why would someone paw through the garbage for hours, battling bees and germs, and then haul smelly bottles uphill in a shopping cart just to make a few bucks? My guess is that it’s to ward off desperation. They make their own work, and they get to eat.

“Some of them may use drugs,” one of the speakers acknowledged last night. “But,” he paused for dramatic effect. “Some of us use drugs, too.”

When sit / lie was under debate, critics wondered where the homeless were supposed to go, if they couldn’t sit on the sidewalks. Often, the reply was that they could go to the parks. But this latest attack on the homeless shows that they aren’t welcome there, either.

I’m not going all crazy on the idea of pretzel stands in Golden Gate Park, or even a lobster-roll place behind the bandshell. I’m kind of against the lease change at Stowe Lake because I hate to see an out-of-town operator take over a local concession (and I like the funky boats, and the popcorn, and the overall 1950s-era quality of the food stand, which — by the way — makes the best soda water anywhere in town, yumm, so extra fizzy and nice ….).


But it’s worth sounding the alarm about the direction that Phil Ginsberg and Mark Buell are taking the Recreation and Park Department. And it’s not just evicting the HANC recycling center.


I realize that the city’s broke, and Rec-park is broke, and if they can’t raise money by selling coffee and lobster rolls they might have to lay off even more recreation directors. I fell the pain. But there’s a dangerous road ahead, and it looks like this:


Once you decide that parks have to pay for themselves, you’ve destroyed the whole notion of public space.


Check out what happened at the Presidio, where a plan by Rep. Nancy Pelosi to tun the park into essentially a private outfit, with the mandate to reach financial self-sufficiency, led to all sorts of problems and set the stage for a debate over privatizing more parks.


This is, of course, part of a larger discussion, but parks are by their very nature supposed to be places that the community — the taxpayers — support and preserve for the good of all. They aren’t supposed to pay for themselves. You’re not supposed to charge admission. Any commercial activity ought to be designed to benefit the users (it’s nice to have a place to buy a bottle of water on a hot day or a snack for your kids) and not to pay the maintenance bills for the facility.


This is what annoys me more than anything else about Gavin Newsom. He talks about vision and sounds like an environmentalist and progressive, but he misses the whole point. You fund public services with tax dollars, not by auctioning them off to the private sector.


At least, you used to.

EDITORIAL: Save the HANC recycling center

The foes of the Haight Ashbury Neighborhood Council recycling center — including the mayor and Rec-Park Director Phil Ginsberg, who desperately want to get the low-income riff-raff who sell cans and bottles for a living out of the Haight and Inner Sunset — pulled out all the stops Dec 2, dragging good ol’ Chuck Nevius, who’s always ready to stand up for what isw clean and well-manicured and free of urban grit, into the fight. The Nevius column in the Chron is almost too perfect; he describes the center as “a noisy, ugly industrial plant” that doesn’t belong in Golden Gate Park. Well, the center is technically in the park, I suppose, but it’s not exactly smack amid Speedway Meadow or the Arboretum; it’s way off on the edge, in an area that most people don’t even think of as the park.

But see, here’s the real issue:

It is a magnet for the down and out, some of whom use the can and bottle payout as an ATM for booze and drugs, and even raid the neighborhood bins to fill their carts.

Imagine: A magnet for the “down and out” in the Haight. Imagine: A way for people to make some money without panhandling (which Nevius dislikes) or hassling tourists (which Nevius dislikes) or selling drugs (which Nevius dislikes) or stealing (which all of us dislike). Imagine: A community-run institution that actually creates green jobs for people who might otherwise be homeless (and doing things that Chuck Nevius dislikes).

The real issue is that the mayor never liked HANC (since he lives in the Haight, he ought to stop by a HANC meeting sometime; it’s really not that scary) and doesn’t like the idea of homeless people congregating around the recycling center, and would just as soon get rid of anything that doesn’t fit his vision of a squeaky clean, fully gentrified city.

And it’s not as if Ginsberg wants to restore that corner of the park to native flora; it will be, in his vision, a community gardening center. Nice, but not exactly a natural space. The new center would also attract small crowds — but of a very different demographic. Which, again, is what this is all about.

The HANC recycling center does everything that Gavin Newsom claims to support. It provides green jobs. It offers employment opportunities for people who are on the margins of society, and lets them get back on their feet — without a penny of taxpayer money. It promotes recycling and sound urban ecology.

The private company that collects our garbage and recycling, which is called Recology, doesn’t like the fact that poor people go around and collect cans and bottles from the blue bins on the sidewalk; the stuff is worth money, and the company would rather keep it. But in the end, the material goes to the same place and stays out of the landfills, which ought to be the point. And honestly, isn’t scavenging and recycling cans and bottles a better occupation than agressive panhandling and crime?

The center’s a bargain for San Francisco, and the personal peeves and suburban sensibilities of Newsom, Ginsberg and Nevius shouldn’t shut it down. The Recreation and Parks Commission should direct Ginsberg to back off on eviction proceedings and let the center stay.

 

 

Emergency forum Tues. / 30 on HANC recycling center eviction

An emergency community forum will be held tonight, Nov. 30, about the Recreation and Parks Department’s plan to evict the Haight Ashbury Neighborhood Council (HANC) Recycling Center from a parking lot in Golden Gate Park. If Mayor Gavin Newsom and his former chief of staff, Rec & Park General Manager Phil Ginsburg, succeed in their plan to evict the 36-year old recycling center, they’ll kill 10 green jobs, eliminate a rare source of income for poor people, and put an end to a community resource that costs San Francisco taxpayers nothing.

HANC believes the recycling center is being targeted by Newsom’s administration as a form of political payback, since the progressive organization opposed Proposition L, the sit / lie ordinance, which Newsom supported.

Ginsburg wants to evict the recycling center, which pays rent to the city, and replace it with a community gardening center that would cost $250,000. The shaded lot doesn’t seem like an ideal site for growing produce.

A memo issued Nov. 29 from Ginsburg to Rec & Park Commissioners notes that it is legal for the department to move forward with the eviction without commission approval. Apparently, Newsom’s administration intends to send 10 people to the unemployment line and kick a 36-year-old green resource to the curb without any public input, despite receiving 400 postcards from San Francisco residents opposing the eviction. The Rec & Park Commission will take up the issue of the new community garden center at its Thurs., Dec. 2 meeting.

Tonight’s emergency forum, organized by Keep Arboretum Free, is an attempt to open up a space for public dialogue.

A stakeholder meeting took place this afternoon with Ginsburg, District 5 Sup. Ross Mirkarimi, Department of the Environment Director Melanie Nutter, representatives from the San Francisco Police Department, represenatives from the offices of Assembly Member Tom Ammiano and City Attorney Dennis Herrera, HANC, and area residents.

Jim Rhoads of the HANC Recycling Center told the Guardian just after the meeting, “They’re going to evict us by the end of December. That’s their goal. The mayor has it in for us and he wants to get us out before he leaves.”

The recycling center, located at Frederick and Arguello streets, operates a buyback program for recyclable materials as well as a San Francisco native plant nursery. Residents from the Inner Sunset Park Neighbors have voiced complaints about “quality-of-life issues” that they link with some of the center’s patrons. During buyback hours, held from 10 a.m. to 3 p.m., people arrive with shopping carts filled of cans and bottles to exchange for small amounts of cash. Some of them are homeless.

Representatives from HANC, Rec & Park, and the Inner Sunset Park Neighbors have been invited to speak at tonight’s forum. “There are strongly felt opinions on both sides,” a flier for the event notes. “In the interest of a broad discussion, a number of long time local residents organized this forum for a full public airing of the issues prior to the Dec. 2 Commission meeting.”

The forum will be held tonight, Tuesday, Nov. 30, from 7 to 9 p.m. at St. John of God, 5th Avenue at Irving St.

Green vs. “green”

Years ago, Greg Gaar was a scavenger, wandering the neighborhoods around Twin Peaks picking up bottles and other kinds of recyclable trash. He began working at the Haight Ashbury Neighborhood Council (HANC) Recycling Center in 1982.

During his tenure, a project designed primarily to divert waste from the landfill expanded to include a unique San Francisco native plant nursery. Located on a converted parking lot on Frederick Street near Lincoln Boulevard, the recycling center is a drop-off for recyclable materials, including used veggie oil, and a source for soil and 65 species of potted plants.

Gaar started small. “I took some seeds,” he explained, “and scattered them into a flat. They came up like fur on a dog’s back.” Over the years, he researched the natural history of the area, saved seeds, and cultivated the grounds surrounding the recycling center. HANC also converted a traffic triangle across the street into a thriving garden.

The Recreation and Parks Department, directed by Phil Ginsburg — former chief of staff to Mayor Gavin Newsom — is seriously considering a plan to evict HANC recycling center and replace it with a garden resource center.

While trading one garden center for another might not seem like a big deal, it appears to be an attack on poor people who make their living recycling cans and bottles, a group that organized to oppose Proposition L, the sit-lie ordinance that Newsom supported in this election.

Or as HANC Executive Director Ed Dunn put it: “He’s going to take it from his enemies and give it to his friends.”

The HANC recycling center has leased Rec and Park property since its inception in 1974, and it’s been at its current location for 30 years. HANC does not receive any city funding for the center, and it pays a small amount in rent for use of the parking lot. It processes roughly 160 tons of recycling per month.

Newsom has worked hard to cultivate his reputation as a green mayor and promote green-job creation, but evicting the recycling center would kill 10 green jobs. Many of the employees were formerly homeless and previously earned petty cash gathering cans to exchange at the center’s buyback station. They were hired without any help from San Francisco taxpayers and now they’re earning living wages while diverting waste from the landfill.

But some neighborhood residents are annoyed by the presence of people who arrive at the center with shopping carts filled to the brim with bottles and cans that they can exchange for cash. Buyback hours are held from 10 a.m. to 3 p.m., so during those times, people who haul around bundles of recyclables line up to receive modest rewards for their hours of effort.

HANC, a progressive organization, publicly and vehemently opposed Prop. L, the voter-approved ordinance that bans sitting and lying down on city sidewalks. Newsom enthusiastically endorsed Prop. L.

Dunn believes the recycling center is being targeted due to HANC’s position on that issue. “It’s all about political payback,” says Dunn. Incidentally, Haight voters rejected sit-lie and HANC sees the pending recycling-center eviction as part of the same agenda. “It’s all part of the gentrification that’s enveloping San Francisco,” said Jim Rhoads, who chairs the HANC Recycling Committee.

Once word of the plans got out, letters started pouring into to Newsom’s and Ginsburg’s offices from the Sierra Club, San Francisco Tomorrow, the Senior Action Network, and other organizations. Additionally, the center’s supporters mailed at least 400 postcards opposing the eviction.

Residents have voiced complaints about the shopping-cart recyclers, some of whom are homeless. The Inner Sunset Park Neighbors (ISPN), which is petitioning Rec and Park to evict the recycling center, has a message posted on its website linking the shopping-cart pushers with “quality-of-life issues such as aggressive panhandling, drug use/dealing, and public safety.” ISPN also charges that the recyclers swipe cans and bottles from rolling curbside bins. The neighborhood group had not responded to requests for an interview by press time.

Rhoads believes that if the recycling buyback program is removed, it would only encourage panhandling — after all, people already lacking basic resources would lose a critical source of income. “People will be very desperate,” he said. According to the results of a HANC survey, one in six recyclers regularly turning up at the center to exchange bottles for cash sleeps outside.

The Recreation and Park Commission will discuss the possible HANC eviction at its Dec. 2 meeting. And since the recycling center is on a month-to-month lease, the 36-year-old green resource could soon suffer eviction. There’s likely to be significant resistance, since the HANC Recycling Center has forged partnerships with urban-agriculture projects throughout the city.

It was a fiscal sponsor of the Garden for the Environment and donated several tons of cardboard for mulching at Hayes Valley Farm. The HANC nursery project has distributed plants to urban agriculture projects throughout the city, including school garden plots, urban habitat corridors designed to protect rare species, and the Mission Greenbelt Project, a network of sidewalk gardens in the Mission.

Details on the proposed garden resource center that would be installed in lieu of the HANC Recycling Center are sketchy. An artist’s rendering of the plan, drawn up by the city’s Department of Public Works, envisions an outdoor classroom amphitheatre, raised garden beds, a semi dwarf orchard, and a composting area. However, Guardian inquiries to Rec and Park requesting more specific details about funding and operation went unanswered by press time.

Cords. Pedals. Buttons. Plugs and pieces. What is electronic music but a soundtrack of electricity flowing from one plastic part to another; a collection of volts humming and vibrating in an ironically harmonious fashion that somehow manages to tantalize our organic bones and flesh? Treasure Island’s Saturday lineup is dedicated to the electronic elements of today’s sound waves, but the event’s artist grouping distorts the genre’s seemingly obvious definition to one that is tattered with new sound bytes and unlikely additions.

Out goes the assumption that “electronic music” equals tranquilized club kids, and in come the offshoots of chill wave, electro-pop, electro-rock, folktronica, dance rock, and all kinds of made-up names. From the dance-party infiltrators, LCD Soundsystem, to the “next level shit” of Die Antwoord, each of the 13 acts playing Saturday’s Island stage hold unique qualities. DeadMau5 and Kruder and Dorfmeister remain strictly digital; Little Dragon and Holy Fuck incorporate traditional instruments; French duo Jamaica bans synth completely, while Miike Snow and Wallpaper might consider their vintage plug-in pianos family members. When it comes to defining today’s electronic scene, DJs and professional remixers definitely count, but the full set of rules is still TBD.

Music is what frees us from our overloaded lives, cutting through our webbed-out existence with sounds that take us “away from it all,” yet electronic music seems to work as both an escape and a reminder. Aren’t we tired of hearing our computers bleep? How about those ridiculously catchy videogame noises and horrid ringtones that rot the brain? Electronically-inclined musicians are adding such sounds to their repertoire, disguising them with mustaches and wigs, tangling them with bass and dreamy melodies then handing them back in a totally rad new package.

It’s a streamlined recycling process, melting, molding, and converting junk sounds into something that injects new movement into our robot routines. No, not everything has been thought of before — here is one area where fresh sounds are being discovered.

In fact, things are so new and up in the air that some bands included in the electronic half of this weekend don’t even consider themselves part of the genre. Sarah Barthel, half of the newest blog sensation Phantogram, is one example, though she and bandmate Josh Carter use a fair amount of outlet-powered instruments like samplers, synths, beat machines, and loop machines. “Sound has so many options today. It’s mind boggling and amazing,” she says while riding in a tour van to Atlanta.

Phantogram’s mysterious electro-rock doesn’t necessarily call out “brand new” when it spins, mostly due to its throwbacks to ’90s trip-hop. But similar to a fair portion of Saturday’s bill, the duo is living somewhere off the classic genre map.

“People will ask, ‘Where’s your drummer? Why don’t you have one?” and I just tell them, ‘We don’t want one,'” Barthel says with a laugh, remembering that just moments prior she had expressed her excitement over Phantogram’s newest addition to the tour family— a real drummer to replace their box with buttons. “In general, we’re just trying to go for a different aesthetic. And typically, more traditional elements like a live drummer wouldn’t fit that. But right now, it’s totally working.”

Electronic music today is full of contradictions — as many loopholes as loops. Anything goes and nothing fits quite right, which is why Antoine Hilarie of Jamaica doesn’t even know how to answer the question, What is electronic music?

“I don’t have the slightest idea, to be honest,” he says, before taking it a philosophical step farther and questioning the point of my question altogether. “Genre-defining is a bit obsolete in my opinion. These days I only listen to bands I like, whether they’re rap, electronic music, rock, or folk.”

It’s a genre that can incorporate all genres, meaning it’s own definition is completely lost for words. But none of the bands on Saturday will be playing unplugged. And if the power does disconnect any of our electric artists, we’ll have a very quiet island.

If you’re an environmentally minded lover of the arts who wants to start hosting cool gatherings on your property, have we got a centerpiece for you! Remember the Panhandle Bandshell? That was the temporary performance venue that a group of local artists built from old car hoods and other recycled materials back in 2007. And now, for the right price, it can be yours.

“It’s a classic bandshell and the ideal use is for community to gather and performers to do their things,” says Will Chase of Finch Mob, which collaborated on the project with Rebar and CMG Landscape Architecture. “If people are interested in recycling and reuse, this is a great example of that in action.”

After its initial (slightly controversial) run on the Panhandle in the summer of 2007, where it hosted regular performances, the bandshell has been more recently been on display at Fort Mason, from where it must be removed by Oct. 8.

Its artist-owners have the opportunity now to move it out to Treasure Island, either for storage or display, but first they wanted to see whether a private party would want to give it a more permanent home. They’re hoping to pull down around $30,000 for the piece, which they’ll pour into other projects, so make them an offer if you’re interested. In the dumps

From Kurt Schwitters’ dwelling-consuming accretion The Merzbau to Tim Noble and Sue Webster’s silhouette-casting garbage heaps, making art from the discard pile is by no means a new gesture. It can still be a potent one, though, as evinced by “Art at the Dump,” a 20-year survey of the fruits of Recology’s artist in residence program at Intersection for the Art’s new gallery space in the historic San Francisco Chronicle building.

Recology’s program — the first of its kind in the nation — has grown immensely since the late artist and activist Jo Hanson first reached out to the Sanitary Fill Company back in 1990 and got her hands dirty. Today, participating artists are provided with a stipend and a studio in which to create work from materials scavenged from the Public Disposal and Recycling Area (a.k.a. “the dump”). The residency also involves community outreach, with artists speaking to the more than 5,000 students and adults who annually attend tours of the city’s garbage and recycling facility.

As in any large group show, the creative mileage at “Art at the Dump” varies. More than a few residents over the years seem unified in their studied appreciation of Robert Rauschenberg’s combines and Joseph Cornell’s shadow boxes, but their final pieces often lack Rauschenberg’s precise eye for juxtaposition or Cornell’s tender hermeticism. Mark Faigenbaum’s (2005) wonderful Pop 66 (2) — a chopped-up 1966 Muni bus poster arranged into a quilt-like pattern of concentric squares — on the other hand, stands on its own as an abstract reconfiguration of its source material while also evoking Charles Demuth’s precisionist oils.

If one artist’s trash doesn’t always make for treasure, at the very least you can count on a conversation piece. A sculpture by Casey Logan (2008) consists of a section of a tree trunk whose upper half has been, as if by the intervention of some magic beavers, whittled into a two-by-four complete with barcode sticker. It is called Destiny. It makes for a humorous pairing with Linda Raynsford’s (2000) two Tree Saws: old handsaws whose rusted blades Raynsford delicately cut into the outlines of forest giants.

Other past residents have taken a craftier approach. Estelle Akamine’s 1993 evening skirt and fantastically fringed cape made from computer tape ribbon could easily pass for one of Gareth Pugh’s recent gothic runway looks.

Perhaps the exhibit’s final word belongs to Donna Keiko Ozawa’s 2001 conceptual sculpture Art Reception, a found jug filled to the top with trash produced during a gallery’s opening reception. Cleverly recalling Oscar Wilde’s famous opening salvo in The Picture of Dorian Gray that “All art is quite useless,” Ozawa’s piece also underscores that the process of art-making — from a piece’s creation to its display — leaves its own set of carbon footprints.

 

DOG DAYS

Robb Putnam’s also no stranger to refuse. The titular orphans in the Oakland artist’s first solo exhibition at Rena Bransten are large, cartoonish canine heads made from compacted scraps of old blankets, fake fur, bubble-wrap, and it seems whatever else Putnam swept off his studio floor.

Mike Kelley’s perverse stuffed animal sculptures and the grotesque composite portraits of Giuseppe Arcimboldo both come to mind here. But with their Augie Doggie-like curves and permanently wagging tongues, Putnam’s mutts are more pitiable than abject. Skinned and beheaded, they are mascots for the unwanted and forgotten.

The show is only up for four more days, so run don’t walk to take in all the plush sadness.

HAIRY EYEBALL New York City construction workers at the World Trade Center site recently unearthed an 18th-century ship hull. More interesting is that scientists believe that the structure was part of the massive landfill that extended lower Manhattan further into the Hudson River. You don’t have to read too deep to hit on the symbolism of this story, even if the occurrence at its center isn’t so uncommon in a city as densely developed and old as New York (see the 1991 discovery of a 200-year old African burial ground, also in lower Manhattan). Beneath the site where the Twin Towers fell lies further wreckage, older ruins. Nothing is ever truly gone. What lies buried will eventually surface. The present is always haunted by the past.

The same could be said of the art world, which has recently been holding some flashy curatorial séances of its own. Two exhibits don’t necessarily make a trend, but the Berkeley Art Museum’s current “Hauntology,” recently reviewed in this paper, and the Solomon R. Guggenheim Musuem’s ongoing exhibit “Haunted: Contemporary: Photography/Video/Performance,” both summon the specters of late-1980s academic theory (Derrida in name and word, in the case of BAM’s show) in their selection of works that address the unseen yet felt presences — aesthetic, historical, political — floating amid the present.

You can also add “Now, It’s About What You Can’t See” to the list, although this group show at Triple Base Gallery of paintings, drawings, and installations is not as enthralled by its organizing principle — what is absent may not be forgotten — as the previously mentioned exhibits are to critical theory and now-old debates around appropriation in photography. As Triple Base’s statement declares, though the artists vary by age and medium, their works, “provide faint shadowy traces of moments to imagine what once existed and hint at an ever-evolving history.”

The faintest traces belong to Rachel E. Foster’s wall installation, which is practically invisible from certain angles. Only by moving back and forth in front of the surface does the repeatedly painted word “ghost” emerge from the seemingly contiguous white field of the gallery’s wall. As in her older works involving text, here, Foster cleverly collapses medium and message, using a representational strategy to bring a word’s meaning to life. In this case, the word “ghost” becomes just that.

Unfortunately, it’s hard not to read Foster’s installation as a commentary on the small group of Eleanor Kent’s early oil paintings, which are hung on the same wall. Inspired by her life in Noe Valley in the 1960s when she was still associated with the Bay Area Figurative movement, Kent’s small-scale domestic scenes — her son playing, a couple talking over dinner — aren’t by themselves elegiac. But Foster’s apparitional wallpaper imbues Kent’s facelessness figures and rough outlines with an air of loss that might not be present otherwise.

Wallpaper is put to different use in Mara Baldwin’s How to remember where you put something, the sharpest and most moving articulation of the show’s preoccupation with absence and memory. Baldwin, it appears, has removed and rehung a large section of old wallpaper. The yellowish pattern of red and yellow flowers has faded with age, as revealed by two brighter rectangles near the section’s center that suggest the spaces where perhaps art or photos had once been hung (curiously, no nail holes are visible). But looking closer, you realize that the paper in the less-faded sections is not the same paper at all, but a continuation of the wallpaper’s design in watercolor.

The piece’s two painted sections aren’t simply indexes for what’s gone missing (which may not have even existed in the first place). Executed by Baldwin’s steady, patient hand, the painted sections also draw attention to what they are intended to replicate: the banal, mass-produced wallpaper that surrounds them. By flattening background and subject, Baldwin makes painting the aid to memory of the piece’s title, while also suggesting that “putting on a new coat of paint” always involves some form of erasure. Chechu Alava’s soft-focus portrait of a sylph-like young woman in a slip is more conventionally ghostly, but not nearly as haunting as Foster’s hidden graffiti or Baldwin’s yellow wallpaper.

 

MORE TOPOGRAPHICS

As I wrote two columns ago in my review of the multi-gallery show “They Knew What They Wanted,” the George Eastman House’s 1975 exhibit “New Topographics” — currently hanging in a reassembled version at SFMOMA — continues to cast its shadow over contemporary art and curatorial practice, particularly where landscape is concerned.

“Land Use,” at Oakland’s Swarm Gallery, could easily be a satellite to both exhibits. Bill Mattick’s color photographs documenting the ecological cost of urban and industrial development in Southern California are the closest relatives to the grim indictments of such “New Topographic” participants as Joe Deal, Robert Adams, and Lewis Baltz. Chris Sicat’s pieces of reclaimed wood “colored in” with soft graphite pencils are less successful as sculptures than as documents of the artist’s attempts to work within natural form of his materials. Sculptor Reenie Charrière takes a similar tack with manmade waste, aggregating the plastic bits that don’t make it to the recycling center into playful, biologic forms.

Trashy art: Recology’s 20 years of shoving artists into heaps

One thing I learned yesterday about the artist in residence program at the Recology dump; Sirron Norris and other alums were not wading through the mountains of lightly used diapers and rotting carrots to cull the materials for the flights of foraged fancy they produce in the program, a 20-year retrospective of which opens today, Wed/21, at Intersection 5M. No no, they pick through the goods turned up by the city’s curb-side and drop-off recycling program, which you think would be a little cleaner. I mean, look at the art they made from it. But you’d be surprised…  

“That section anyone can drop something off is where you garbage pick,” artist Sirron Norris tells me when I called him up for comment on the sweet gallery show Recology’s assembled. He assured me that the dump’s program changed his artistic trajectory, and yet “You will come across rotting food — vegetables and rotting stuff. They’ll dump fish in the styrofoam cases, a lot of vegetables — a lot. Ive seen all kinds of stuff, nasty stuff and trippy stuff, a box full of stuffed animals; a box you could fit a loveseat in [note: here Norris commenced with a story about said box I don’t feel comfortable relating to my gentle readers. Ask him for details when you see him, dear ones]. Tons of pills, so many pills. Cough syrup.” 

“It’s up to them if they want to wear a respirator,” says dump advisory board member (and program director for Intersection for the Arts, who let us into the building even though I blatantly got the day wrong of the exhibit’s opening reception – thanks!) Kevin Chen. Artists, who spend up to eight hours a day at the recycling facility, are encouraged to wear not only steel toed boats, but also steel soled boots. Tre rugged, no?

But judging from the gems assembled at the Recology retrospective, the experience is more than worth the sanitary incursions. A kicky dress made from bottle caps and junk food wrappers by Remi Rubel hung next to Sandy Drobny’s intricately woven “Caution” tape apron. I wanted them for my own, just like I wanted to sit and finger Linda Raynsford’s saws carved to resemble their enemies in nature, the majestic fir tree, every day before I head to work. 

What I saw yesterday

The retrospective provides a lot to look at, nearly all of it made from things that otherwise would have been crushed into recycling. Packard Jennings created a “Terrorist Alert” board during his 2003 residency, which he installed on Division Street to warn post- 9/11 automobile drivers of threat levels approaching the ominous “pineapple” or “far-fetched” measure of urgency. David Hevel’s trio of bright fascinators – which he reverse-melts with a blowtorch in a video installation included in the gallery – baffled me with their preciousness until Chen cleared up their providence. “Sometimes a party store will drop off a whole bunch of stuff,” he said. Ah, streamers and sparkles, got it. 

Perhaps for obvious reasons, the residency program is an SF exclusive in this country. Chen says a similar program is being plotted for Portland, Oregon, but the set up – which allows artists free range in the recycling area in exchange for giving Recology temporary ownership of the pieces created, plus a few for their permanent collection – is mainly made possible here by a dump administration who, Chen told us, “really loves art.” Thanks guys! The whole thing left me stoked to check out the actual trash heap itself, where a sculpture garden lives and where regular gallery openings give people a chance to see their waste in a whole new light. 

Just like Norris did. “You’d see these piles and the piles would have these really great stories,” the artist told me, speaking as a man who knows the worth of another’s cast-offs. “I furnished my entire apartment from that place — cool stuff too, like old displays from Radio Shack.”

Lennar’s litmus test

None of the many stakeholders tracking the progress of Lennar Corp.’s massive Candlestick Point-Hunters Point Shipyard redevelopment plan registered surprise when the Board of Supervisors received three appeals to the Planning Commission’s June 3 certification of the project’s final environmental impact report (FEIR).

Instead, everybody who has been watching the political juggernaut that has been pushing for quick approval of the project over the past month said they anticipated that the FEIR would be appealed, and perhaps litigated. But the real question is whether the project will be substantially changed.

In the seven months since the project’s draft EIR was released, the Planning and Redevelopment Commissions have repeatedly rejected all arguments and recommendations made by its critics to improve or delay the plan, rushing the approval along on a tight schedule (“The Candlestick Farce,” 12/21/09).

The rush job occurred even as numerous groups and individuals warned that the DEIR comment period was too short, (“DEIR in the headlights,” 02/03/10) and complained that the city and the developer had dismissed crucial data and testimony while exploiting fears the San Francisco 49ers would leave town if the city didn’t act quickly (“Political juggernaut,” 06/02/10).

What’s less clear is whether the Board of Supervisors has the political will to heed these appeals and correct what opponents say are serious flaws in the city’s FEIR. The appeal that the Sierra Club, Golden Gate Audubon Society, California Native Plant Society, and San Francisco Tomorrow filed June 21 lists nine deficiencies.

These included the FEIR’s failure to look into an alternate Bus Rapid Transit (BRT) route around Yosemite Slough or adequately assess impacts resulting from the landfill cap on Parcel E2 and the transfer of 20 acres of public shoreline land in Candlestick Point State Recreation Area (CPSRA) to build high-end housing.

“The FEIR failed to analyze those elements of the project’s sustainability plan that could have significant environmental impacts, including two proposed heating and cooling plants (which appear to be power plants) to serve 10,500 housing units and a projectwide recycling collection system,” the coalition further charged.

The appeal also voiced concern that the FEIR failed to adequately assess impacts resulting from the construction and maintenance of the development’s underground utility matrix, impacts to the bird-nesting in the proposed 34-acre wetland restoration project at the state park, and delays to eight Muni lines.

But the Sierra Club-led coalition also indicated that by removing provisions for a bridge over Yosemite Slough, transfer of land in the state park, and compromised clean-up efforts at Parcel E2, resolution of many of these disputed issues could be expedited.

“If the Board of Supervisors acts promptly, revisions to the EIR may be made quickly and result in a minimal delay in the progress of the project,” the coalition stated.

The Sierra Club’s Arthur Feinstein told the Guardian that the coalition’s top three concerns are “very important, but the six other issues are also very real.”

“Here we have a city cutting 10 percent of its bus service while saying that eight bus routes will need to be improved because of the project, and admitting that the development will increase air pollution in a district that has the highest rates of asthma and cancer without identifying mitigations such as reducing parking spaces in the proposal,” Feinstein said.

POWER (People Organized to Win Employment Rights) also filed an FEIR appeal June 21 listing a broader range of environmental and economic justice-related concerns.

These included the FEIR’s failure to analyze and mitigate for displacement that would be triggered in the surrounding neighborhood by developing 10,500 mostly market-rate housing units in the area and “failure to provide for adequate oversight and enforcement of the terms of the early transfer” of the shipyard from the Navy.

POWER also cited the FEIR’s failure to adequately mitigate against the impact of sea level rise, the risks associated with potential liquefaction of contaminated landfill at the shipyard in the event of an earthquake, and health risks related to chemicals of concern at the shipyard. The group also faulted the city’s failure to get the Navy to prepare an environmental impact statement on its clean-up plan before the FEIR was completed.

Finally, Californians for Renewable Energy (CARE) filed a five-point appeal June 23 charging that the project contravened the intent of Proposition P (which voters approved in 2000, urging the Navy to remediate shipyard pollution to the maximum extent possible), that the project’s FEIR is incomplete because the Navy (which still retains jurisdiction over the project lands) has not yet completed its EIS, and that the FEIR approval process was tainted by 49ers-related political pressure.

“The pre-set goal of maintaining the 49ers in San Francisco has colored the environmental analysis of this decision,” CARE noted, referring to the city’s rush to get the project’s FEIR certified on June 3 — five days before Santa Clara County voters approved a new stadium for the 49ers near Great America .

The appeal filings mean the Board of Supervisors is required to hold a hearing within 30 days, a move that places a roadblock, at least temporarily, in the way of the city’s tight schedule to secure final approvals for Lennar’s megaproject before summer’s end.

Board President David Chiu told the Guardian that the Board’s Land Use Committee will move forward with a July 13 meeting to hear a list of proposed amendments related to the underlying plan along with the FEIR appeals.

“We are back at the board Land Use Committee July 12 with 10 items related to the project,” said Chiu, who is a member of the Land Use Committee. The three-member committee is chaired by Sup. Sophie Maxwell, who represents the project’s District 10; Sup. Eric Mar is vice-chair.

“The next day, July 13, has been tentatively set for a full meeting of the full board,” Chiu continued. He acknowledged that the FEIR related materials are dense and complex, telling us that “they form the largest pile on my desk, and it’s about five inches high.”

But he wasn’t about to prejudge the outcome. “We do need to clean up the area and rebuild it in such a way that it will dramatically increase affordable housing and jobs and support a livable diverse community,” Chiu said. “Obviously there are still a lot of questions and concerns about the proposed project and the board will push to make sure all these issues are adequately addressed.”

CARE president Michael Boyd said he hoped the board would take his group’s appeal seriously and fix the plan’s fundamental shortcomings. “That means going back to square one,” he said.

But others were less sure that the board would seek to overturn the entire plan. “Everyone in the community would like the best level of clean-up,” said Saul Bloom, whose nonprofit Arc Ecology has tracked the proposed shipyard clean-up for three decades. “But what’s possible and practical? And will the city be supportive of that or the most expeditious solution?”

Bloom reserved gravest concern for plans to cap, not remove, the contaminants from the shipyard’s Parcel E2. “The concern is that if you put a cap on E2 without a liner then contaminants could scootch out during a seismic event, or over time, and cause problems because of the parcel’s close proximity to surrounding groundwater and the San Francisco Bay,” he said. “But to place a liner in there is very expensive because you’d have to excavate E2, at which point you might as well replace it with clean soil.”

Bloom acknowledged that the Navy has argued that excavation would cause a nasty smell and nobody knows what is going to be released in the process.

“But long-term Bayview residents like Espanola Jackson have made the point that the community already lives within nose-shot of the southeast sewage treatment plant and would rather put up with a few years of nasty smells, given the relative benefits of cleaning the yard up,” he said. “And how do we know a cap will be protective given the Navy’s argument that we don’t know what’s down there?

“The thing that makes the most sense here is to clean up the shipyard to the best possible extent, but the city isn’t planning to do that,” Bloom added. “And the environmental community’s bottom line has always been the bridge [over Yosemite Slough, which the Sierra Club opposes]. So the sense is that if the bridge goes away, so does their problem.”

Environmental groups appeal final EIR on Lennar’s Candlestick/Shipyard plan

The Sierra Club, the Golden Gate Audubon Society, the California Native Plant Society’ and San Francisco Tomorrow have filed an appeal with the Board of Supervisor’s and the city’s Planning Department over the Planning Commission’s June 3 certification of the city’s controversial final environment report (FEIR) for Lennar’s Candlestick Point/ Hunters Point Shipyard redevelopment project.

The move means that the FEIR, which otherwise would not have come before the Board for review, now heads to the Board for a hearing within 30 days of the group’s June 21 appeal filing. The move also means that the City, which laid out an aggressive schedule for seeking approvals from a myriad of government agencies and departments, cannot seek further approval actions on the project until the Board holds a hearing, which will likely occur on or before July 20.

The San Francisco Bay chapter of the Sierra Club, the Golden Gate Audubon Society, the California Native Plant Society’s Yerba Buena Chapter and San Francisco Tomorrow cited nine major deficiencies in their appeal , but noted that by removing plans to a) build a bridge over Yosemite Slough, b)erect luxury condos on state parkland and b) compromise clean-up efforts at Parcel E2, which is the most polluted land at the shipyard, resolution of many of these disputed issues could be expedited.

“If the Board of Supervisors acts promptly, revisions to the EIR may be made quickly and result in a minimal delay in the progress of the project,” the appeal warns. “Alternately, resolution of many of these disputed issues may be expedited by a decision to remove from the FEIR and Project Plan the provisions for the bridge over the Yosemite Slough, the transfer of land in Candlestick Point State Recreation Area, and compromised clean-up efforts at Parcel E2.”

In their appeal, the four groups noted that they each group and its members represent “a sizeable constituency that has been actively participating in the development of the EIR” for almost a decade and that has conducted or funded studies to inform the Draft EIR and has filed comments to the DEIR and other planning documents.

“Unfortunately, the data, comments and testimony provided by the Appellants and their members have been dismissed or outright ignored by the Planning Department and the developer in this process, resulting in fatal flaws in the FEIR and necessitating this appeal,” the four groups state.

‘Because many portions of the FEIR are inaccurate and incomplete, the Planning Commission erred in adopting several findings and certifying the FEIR,” the appeal concludes. ‘Therefore, we are appealing the FEIR because:
1.    The FEIR failed to adequately analyze an alternate Bus Rapid Transit (BRT) router around Yosemite Slough;
2.    The FEIR failed to adequately assess impacts resulting form the landfill cap on Parcel E2, which is a lower standard for the clean-up than required by San Francisco voters as expressed in Proposition P;
3.    The FEIR inaccurately and incompletely assessed the impacts from transferring approximately 20 acres of public shoreline land in Candlestick Point State Recreation Area to the developer for construction of high-end housing;
4.    The FEIR failed to analyze those elements of the project’s Sustainability Plan that could have significant environmental impacts, including two proposed heating and cooling plants (which appear to be power plants) to serve at least 10,500 units in the Project and a Project-wide recycling collection system;
5.    The FEIR failed to adequately consider impacts to the bird-nesting island component of the Candlestick Point State Recreation Area’s proposed 34-acre Wetland Restoration Project, which is already permitted and planned for construction this year;
6.    The FEIR failed to adequately address impacts to eight MUNI lines, which would significantly increase transit times, increase delays during peak hours, potentially dissuade ridership, and/or require increased service, busses, or drivers;
7.    The FEIR failed to adequately assess impacts resulting from the construction and maintenance of the Project’s underground utility matrix;
8.    The FEIR failed to adequately address the fact that the Project will result in increases in air pollution that will exceed existing air quality standards—indeed even though the FEIR admits exceedences of air quality levels will occur, those statements are underestimates because the FEIR failed to consider that the development in combination with other development plans will result in significant traffic congestion on Highway 101 and Interstate 280 and fore more traffic onto surface streets; and
9.    The FEIR included conclusions based on false, inaccurate and/or biased statements as “evidence,” including (but not limited to) that one cannot have an ‘undisturbed nature experience” in an urban area as a rationale for dismissing impacts that will inevitably result from construction of the bridge over Yosemite Slough and/or the reduction of public land in the Candlestick Point State Recreation Area.

In their appeal, Mike Lynes, Conservation Director Golden Gate Audubon Society, Linda J.Shaffer, Vice President, California Native Plant Society, Yerba Buena Chapter, Jennifer Clary of San Francisco Tomorrow, and Arthur Feinstein, Sierra Club, San Francisco Bay Chapter, promised that each of the abovementioned deficiencies will be further documented by additional submissions to the record prior to a hearing on this appeal by the Board.
