Pedal power

Hundreds of bicyclists invaded City Hall July 21 to demand safer bike routes and decry new bureaucratic delays in environmental review work on the Bicycle Plan, which a judge said the city must complete before it can make any improvements mentioned in the plan, from new lanes to simple racks (see "Stationary biking," 05/16/07).

But they arrived a couple hours too late to change the tenor of a hearing on another priority for car-free advocates: the Sunday Streets proposal by Mayor Gavin Newsom to close the Embarcadero to cars Aug. 31 and Sept. 14, which is being challenged on procedural and economic grounds by Board of Supervisors President Aaron Peskin and conservative supervisors.

Presentations to the board’s Government Audit and Oversight Committee in support of Sunday Streets were overshadowed by a big turnout of merchants from Pier 39 and Fisherman’s Wharf — who have vociferously opposed the proposal, citing concerns about lost business — and labor leaders, who unexpectedly lent their support to Peskin’s play.

"We just don’t want to have a beta test of a new program on one of the busiest days of the year," said Karen Bell, executive director of the Fisherman’s Wharf Community Benefits District. "People want to drive down the Embarcadero. They don’t want to take side streets."

Advocates of the program are resisting Peskin’s effort to postpone the events until after an economic study can be done.

"Every other city that’s tried this has found it has tremendous economic benefits, as well as tremendous health benefits and social benefits," said Andy Thornley, program director for the San Francisco Bicycle Coalition.

The committee moved Peskin’s resolution to the full board with no recommendation after Sups. Sophie Maxwell and Tom Ammiano voiced support for Sunday Streets. It was set to be heard July 22 after Guardian press time, but Mayor’s Office officials said they intend to hold the events as scheduled no matter what the outcome and work with opponents to ease their concerns.

But most cyclists were focused on the Bike Plan, which might not have final approval until late next year, as an afternoon Land Use Committee hearing called by Sup. Gerardo Sandoval revealed.

Bicycle Advisory Committee member Casey Allen called the delay unacceptable, and said he’s working with others to formally intervene in the case next month, arguing that unsafe conditions are a public health issue demanding immediate action.

"We have to take risks sometimes and challenge the status quo," Allen said. "That’s how we move forward as a society."

The challenge to Newsom…and all of us

It’s not easy to create carfree spaces in automobile-obsessed California, even temporary ones, as Mayor Gavin Newsom is starting to learn. His proposal to create a carfree “ciclovia” along the Embarcadero from Bayview to Chinatown was already scaled back from his original proposal of three consecutive Sundays in August to the recently approved plan for four-hour events on Aug. 31 and Sept. 14.
Merchant groups from Pier 39 and Fisherman’s Wharf lost their minds, screaming with fears of lost business even though motorists will still be able to access their tourist traps by car, and they’ll be joined by thousands of people pedaling, walking and skating past their businesses during prime breakfast and lunch hours. And now members of the Board of Supervisors have added their voices to this shrill chorus.
I knew there would be outrage, and there has been opposition in every city where it’s been tried (and it’s ultimately become popular everywhere it’s been tried). Unfortunately, Newsom has a history of caving in to overentitled motorists. So the challenge now for Newsom — and for all of us concerned about climate change, public health, and the promotion of sustainable forms of transportation — is to do what’s right in the face of fearful proponents of the status quo.
Because creating eight hours per year of carfree space along the San Francisco waterfront is the least we can do.

Nuclear fallout

As the US Navy prepares to deal with its radioactive past at the Hunters Point Shipyard (HPS) — inviting folks to submit comments by July 28 on its proposed cleanup plan for Parcel B — community members are struggling to understand the threat and its implications.

Bayview–Hunters Point residents and environmental and public health advocates gathered July 8 at City College’s Southeast Community Facility to hear from and question Navy officials, but few came away satisfied. Most expressed doubts about the Navy’s credibility, or confusion about the exact risks to human health and the environment from the plan to clean up radiological, soil, and water contamination.

For the past 25 years, this 59-acre property has housed a colony of artists in the site’s Building 103, in studios rented through the San Francisco Redevelopment Agency. In September the artists will be ejected, either to portables and buildings on the shipyard or to an offsite location, so the Navy can excavate the building’s storm drains and sewers where low levels of radiological contamination have been found.

HPS Base Realignment and Conversion Environmental Coordinator Keith Forman explained at the meeting that when the Navy first presented a cleanup plan for Parcel B in 1997, it had not surveyed for radionuclides, remnants of the shipyard’s military past.

That 2001 survey revealed that there are 14 sites on Parcel B that may have been exposed to radiation, including Building 103. The Navy’s 2004 Historical Radiological Assessment reveals that while Building 103 began as a non-nuclear submarine barracks, Operation Crossroad personnel subsequently used it as a decontamination center after an atomic test went awry in July 1946 in the South Pacific.

In that test, the Navy detonated two bombs the size used on Nagasaki in the lagoon of Bikini Atoll. One bomb, the HRA notes, was an underwater burst called Shot Baker, which "caused a tremendous bubble of water and steam that broke the ocean’s surface."

"Then a huge wave, over 90 feet high … rolled over target and support vessels as well as the islands of the atoll," the HRA records. "Vast quantities of radioactive debris rained down on the target and support ships, islands and lagoon."

Seventy-nine ships were sent to the Navy’s radiological center at Hunters Point Shipyard for decontamination, a site chosen in part because University of California, Berkeley and Stanford University were nearby to support the radiation studies.

The following year, from April through August 1947, the Navy burned 610,000 gallons of radioactively contaminated ship fuel at HPS. Also, workers sandblasting contamination at the shipyard’s dry docks showered in Parcel B’s Building 103, raising the current concern that cesium-137, cobalt-60, plutonium-239, radium-226 (from radioactive decay of uranium-238) and strontium-90 could be present in underground drains and sewers.

The 2004 HRA also identified two plots on Parcel B, IR07 and IR18, as having been used as dumps for radioluminescent devices and possibly more sandblast debris. It also listed a discharge channel between a pump house and Drydock 3 as radiologically impacted.

Currently the Navy is proposing to excavate soil from IR-07 and IR-18, including known mercury and methane spots, and ship it to dumps in Idaho and Utah; fill and seal the suspect discharge channel; cover potentially radiologically impacted soil; and stipulate that these two areas be used as open space in future plans for the base.

The cost of the Navy’s proposed radiological cleanup is $29.6 million. The Navy also proposes spending $13 million on amended soil and sediment cleanup, and $2.7 million on amended groundwater remediation.

Forman told the crowd that the Navy’s old soil remedy was a "bad fit." Excavations were larger than expected, Forman said, and showed no pattern of release. "There was no end in sight for the Navy," Forman said. "It didn’t look as if we were doing what we were meant to do: namely, find Navy-caused spills."

Forman also criticized the Navy’s old groundwater remedy as being "very passive." He proposed a remedy that includes more monitoring along the shoreline and using contaminant-eating bacteria to cleanup groundwater contaminants.

"The old remedy did not consider risks to wildlife and aquatic organisms at the shoreline, whereas the amended remedy will," Forman noted. "It was silent on this issue, yet we know the area has a shoreline."

Ultimately, amending the Navy’s cleanup plan is "about protecting human health and the environment," Forman said.

Green Action’s Marie Harrison was critical of the Navy’s failure to explain the risks in simple terms. "You talked about risk assessment, but you never told us what the risks were," Harrison said. "What is the risk to human life? How is capping going to stop it going into the bay? I’m not a scientist. I don’t have a PhD. I was hoping you were going to give me some kind of knowledge."

Harrison also worried that the Navy was not factoring in the cumulative risks for people living and working in the surrounding community who visit the shoreline to relax. Told that manganese, nickel, and arsenic are present in risky quantities, Harrison was referred to online information at www.bracpmo.navy.mil and to documents housed at the San Francisco’s Main and Third Street libraries.

Other community members criticized the Navy for not doing enough outreach to the Samoans, Latinos, and Asians in the community, and for having taken too long to acknowledge radiological impacts.

"Do you really want us to believe that no one was aware of nuclear waste and spills, given this was a Superfund site?" said Espanola Jackson, a BVHP resident since 1948.

"What I expect you to believe," Forman replied, "is that until 2002, no one who had technical and scientific expertise had looked at the evidence, sifted through history, and done an analysis to put together a radiological assessment."

Jackson also accused the Navy of "fast-tracking the cleanup in order for Lennar to build houses," referring to the efforts of Mayor Gavin Newsom, Speaker of the House Nancy Pelosi, and others to hasten the shipyard’s cleanup and early turnover to the city so the area can be turned into a massive development project pursuant to the voter-approved Prop. G.

"We are not going to accept anything less than total cleanup," Jackson said. "If you have to move that dirty dirt, do it. We need $10 billion. You said $60 million. You can’t even scrape the surface with that amount."

Melanie Kito, the Navy’s lead remedial project manager, replied that the Navy is "chartered to clean up releases of spills from Navy activities. Whatever remedy we put forth, we have to demonstrate that we are protecting human health and the environment."

Kristine Enea, a member of the community-based Restoration Advisory Board, told the Guardian that she felt that the Navy did not do a great job of explaining the risks of contaminants in, say, a major earthquake.

"If there’s an earthquake, would the risk be like getting 10 x-rays at once, or having a three-headed baby?" Enea said.

Pamela Calvert, deputy director of Literacy for Environmental Justice, told the Guardian she’s worried about shipping the contamination elsewhere.

"I’m really concerned that we don’t solve problems in Bayview by creating ones for another community," Calvert said. "It’s best to deal with it here. There is no such thing as ‘away.’ It’s someone else’s backyard."

Saul Bloom, executive director of Arc Ecology, which does contract work for the Redevelopment Agency, said that Calvert’s concerns strengthen the argument for simply capping Parcel B so that the contamination can’t escape rather than removing the material.

Bloom said he blames the Navy’s "incompetence" for the city losing the opportunity to transfer Parcel B early and speed development. "If we’d got rid of Parcel B in 2004, we would have been part of the housing boom, not the housing bust," Bloom said.

He believes the Navy’s proposed plan is acceptable, feasible, and protective, but that "whether it’s the best use given the needs of the BVHP is another debate."

While some residents are arguing for a total excavation of the site down to the sea floor, Bloom disagrees: "I think the covering strategy is a protective solution." He criticized the Navy for only having scheduled 11 days between its July 28 public comment deadline and its final draft, due out August 8.

"I’m concerned about the length of time they’ve allotted for the question that comes up and that no one has the answer to," Bloom said. "I don’t think it is adequate or seemly from a ‘we take your comment seriously’ point of view."

Shipyard artist Rebecca Haseltine, who has rented at Building 103 for 18 years, says that she has consistently trusted Arc Ecology’s advice on the shipyard cleanup. "But I also feel that we still don’t know the half of what happened on the shipyard. The Navy denied that any radioactive material had been used at the base, until a reporter with the SF Weekly published a story about it in 2001."

The carfree challenge

GREEN CITY A large group of San Francisco’s top alternative transportation advocates traveled to Portland, Ore., for the Towards Carfree Cities international conference June 16-20, marveling at a transportation system widely considered to be the most progressive in the United States.

"Portland is light-years ahead of everyone else in this country," said Leah Shahum, executive director of the San Francisco Bicycle Coalition, who attended the conference along with representatives from the San Francisco Planning and Urban Research Association, San Francisco State University, prominent urban design firms including Arup (which is designing the new Transbay Terminal project), architect David Baker, and other institutions.

Public transit in Portland is extensive, cheap, frequent, and easy to use, with the Max line — unlike Muni — allowing bicycles on the trains. Walking is encouraged by new design standards and public information campaigns. A riverside freeway was replaced by open space years ago. And the large network of bicycle paths and other improvements to promote cycling have made Portland the only large city to earn the putf8um designation from the League of American Bicyclists (San Francisco is one tier down at gold).

"But the reality is Portland is far from being great," was the sobering assessment from keynote speaker Gil Peñalosa, the former parks director of Bogotá, Colombia, who pioneered carfree policies there before pushing the issues internationally through the nonprofit Walk and Bike for Life.

Cities are facing multiple crises connected to over-reliance on the automobile — declining public health, environmental degradation, resource depletion, loss of community, and not enough space in US cities to handle the 100 million people they’ll need to accommodate in the next 35 years. And Peñalosa said most are responding with baby steps that deny the scope of the challenge.

"We’re not doing enough," he said, noting that even the best US cities are way too dependent on automobiles compared to cities that have made the biggest advances in reducing automobile use, such as Copenhagen, Amsterdam, Berlin, Paris, Barcelona, and Vancouver.

"That’s where Portland belongs, and that’s the challenge," Peñalosa said. "Under existing conditions, we have to make major leaps instead of baby steps."

It was the first time that this eighth annual conference has been held in the United States, and organizers said they hoped its message will resonate in a country that needs to change profoundly if it is to efficiently manage its growth while playing a positive role in dealing with global climate change.

Many of the ideas raised at the conference and pursued in Portland are beginning to spread. The conference opened with Depaving Day, a pavement-removal effort that has many adherents in the Bay Area, and closed with Sunday Parkways, during which a six-mile loop in North Portland was closed to cars. Such "Ciclovias," which Peñalosa started in Colombia, are planned this August in New York City and San Francisco.

"There are people from all over the world doing amazing work," said local conference coordinator Elly Blue of the Portland group Shift, which organized the conference to coincide with Portland’s annual Pedalpalooza, two weeks of fun bike events and other festivities.

Many attendees noted that global warming, high gasoline prices (and the specter of Peak Oil), worsening public health, and persistent traffic congestion have made many big city leaders more open to carfree concepts than they’re ever been.

"The climate is changing," League of American Bicyclists director Andy Clarke said. "This is our time. It’s our moment to seize the opportunity and change our communities."

Mia Birk, Portland’s former bicycle-policy coordinator, added, "We’re not anti-car, but we’re trying to create a system where walking and biking are viable transportation options." Birk now runs Alta Planning and Design, which is working on carfree and car-light projects with hundreds of cities around the world, including some in the Bay Area.

"What we’re talking about is a true cultural revolution to encourage that kind of shift," Birk said, inviting the crowd to "be a part of that revolution."

Towards Carfree Cities: Treasure Island as case study

Could Treasure Island go carfree? That was the intriguing question that Gus Yates, president of the Berkeley-based nonprofit Carfree City USA, posed during a thought-provoking presentation he gave last week at the Towards Carfree Cities conference in Portland.

The question goes to the heart of whether U.S. cities are prepared to take more than baby steps toward reducing automobile dependence. Treasure Island, which is being redesigned almost from scratch, is close to the urban core and faces significant challenges to accommodating thousands of new motorists. If not there, where?

The question wasn’t simply an abstract exercise, but a serious proposal that Yates formally presented last year to Kheay Loke, senior project manager with Wilson Meany Sullivan, the lead developer for Treasure Island, which is proposed to include about 6,000 new housing units.

The compelling arguments that Yates makes – and the reasons that Loke offered for turning Yates down – shows how, in the minds of current decision-makers, capitalist imperatives still trump the need to seriously wrestle with global warming, traffic congestion, declining public health, and other byproducts of automobile reliance.

Newsom’s backwards budget

EDITORIAL The San Francisco city employee union that represents front-line workers has come up with a remarkable document. It’s an analysis by the city controller, requested through the office of Sup. Aaron Peskin, that shows how many jobs have been added or cut in the past 10 years, broken down by bargaining group.

Since almost all San Francisco employees, including managers, are unionized, and different categories of workers have different unions, the analysis paints a clear picture of where hiring has taken place and where job cuts have hit hardest. It is, in many ways, a snapshot of the budget priorities of Mayor Gavin Newsom. And as Sarah Phelan reported this week on sfbg.com, here’s what it shows:

As direct public services have been hacked up and eliminated, as homeless shelters close and nursing services for elderly shut-ins vanish, the city has hired a whole lot of new high-paid managers.

In fact, in the past decade, the city has added 334 high-level jobs, paying an average of $140,000 a year. That’s a 45 percent jump. Under Newsom’s administration, during tough budget times, 166 new managers have been added. In this year’s budget alone, Newsom is calling for 52 new managers.

Professional and technical jobs increased by 781 positions, a 23 percent rise.

Front-line jobs, on the other hand, have grown by less than 10 percent.

Of course, the city needs managers and technical staff. Some of the new positions are entirely legitimate and justified. But these high-level jobs are also where political cronies are placed, and management jobs in this city have always had a political patronage element. And when the budget is deeply in the red, it doesn’t make sense to lay off the people who are doing the day-to-day work and hire more people to supervise a reduced staff.

Let’s look at the numbers. The total tab for new managers amounts to about $46 million a year. The increase — just the increase — in management positions in this year’s budget would total $7.8 million. That would save a lot of services: Newsom shut down Buster’s Place, the city’s only 24-hour drop-in center for the homeless, to save $300,000. Keeping public health nurses to serve sick seniors would cost only a few hundred thousand more.

The daily newspapers have ignored this story so far, but it’s the blockbuster of the budget season. It shows where the mayor puts his priorities, what he really cares about. He’s got exotic positions like a director of sustainability, in his own office — which is a wonderful idea, but with a budget deficit of more than $300 million, is it really worth $160,000 a year? (Don’t we already have a Department of the Environment?) He’s got people out at the airport who collect six-figure salaries and do very little visible work. And yet he can’t manage to keep basic services for the needy — services that can make the difference between life and death on the streets — from vanishing in a whirlpool of red ink.

Peskin has made some noise about cutting high-end jobs instead of rank-and-file positions, but with the budget coming to a head soon, that ought to be one of the top priorities. In fact, the board’s Budget Committee ought to issue a challenge to the mayor: before another homeless program is cut, before another public health service is eliminated, before another city agency that does on-the-ground work to help low-income people is gutted, Newsom should demonstrate, job by job, why so many $140,000-a-year positions are critical to the city.

The other glaring problem with the budget is that it includes no plans for increased revenue.

Newsom is happy to blame Gov. Arnold Schwarzenegger for terminating aid to cities, but let’s face it: with Republicans in Sacramento and Washington DC, San Francisco is going to have to solve most of its problems on its own. This is nothing new; Newsom should hardly be shocked by it.

If the mayor wants his budget to be taken seriously, he should immediately announce that he’s supporting Peskin’s two revenue-generating measures on the November ballot and do all that he can to help them pass. Then he can add another $50 million or so to his budget, based on the projected revenue, and save a lot of crucial services that are now facing the ax.

Moth Spray stopped! Sterile moths, instead, in urban areas

The California Department of Agriculture and US Department of Agriculture just announced that they will be using sterile moths, and NOT aerially spraying pheromones, at least over URBAN areas as part of their Light Brown Apple Moth eradication program.

Spraying will proceed in non-urban areas, non-accessible by driving, such as national forests, CDFA Secretary AG Kawamura said.

Sterile releases of adult moths are expected either in late fall, or early in 2009, beginning with 500,000 adults sterile moths, and working up to 20 million a day, by 2011.

“This technology looks like it might be going to ramp up faster,” CDFA Secretary AG Kawamura said, stressing that he is still very convinced that aerial pheromones are a “remarkable tool,” and claiming to be, “pleased that we don’t have to go with an aerial application over urban areas, because we feel progress with sterile moths will fit in with our urban eradication program.”

Kawamura defined urban areas as residential areas, not faming areas, and included in his urban definition Monterey and Santa Cruz counties, where the aerial spraying program was initiated last summer.

Pheromone technology will continue to be used on twist ties and plans to release parasitic wasps go forward.

“When we started in July/August 2007, we had made such progress from days of malathion, but the challenge of doing public outreach,” said CDFA Secretary Kawamura, the closest he came to admitting that the reason for abruptly abandoning the aerial pheromone spraying program lies with the tremendous public uproar that ensued.

A planned environmental impact report of the LBAM eradication plan will go ahead, Kawamura confirmed.

Thousands of sterile moths will be released across California to create mating confusion and cause a population crash of the moth which continues to be classified by state and federal agencies as a worrisom invasive pest.

The pilot sterile moth program will be dictated by a trapping program that shows where the highest or expanding populations are found, Kawamura said.

As for concerns that all synthetic pheromones could pose health concerns, even on twist ties in trees, Kawamura begged, “Please listen to public health officers about safety of pheromone twist ties. “If this moth gets established, the burden of having to deal with it…we’re just trying to keep the damage out, by using the best and safest environmental tools available.”

San Francisco City Attorney Dennis Herrera, whose office has been working with public law offices and community organizations throughout the Bay Area to monitor the CDFA’s plans with respect to the program, issued a statement in response, saying “The state’s aerial spray program has been a dead man walking since April, when a Santa Cruz Superior Court ruled that an environmental impact report was required to fully assess potential human health risks. So, I’m glad CDFA appears to have accepted the inevitable. At the same time, I intend to continue to work closely with other public law offices throughout the Bay Area to monitor LBAM eradication plans in the event legal action becomes necessary to protect public health and safety.”

There are memos posted on the California Department of Agriculture’s website, sent from CDFA to Gov. Armold Schwarzenegger, and from Arnie to AGK, (CDFA Secretary AG Kawamura) being mutually supportive about the decision to stop the spray and start the release of sterile moths, instead, memos that confirm insider rumors that Arnie privately conceded that the moth spraying program was a no-go, at the beginning of this week.

Budget Battle bumps up against Gay Marriage

As LGBT couples were praising Mayor Gavin Newsom for making legally wedded bliss a reality in their lifetimes, a parallel community inside City Hall was criticizing the Mayor for making potentially fatal cuts to public health programs, many of which have served San Francisco’s LGBT community for decades.

Unfortunately, between all the gay marriage hoopla going on in the marble corridors of City Hall, and the burn out that non-profits are already feeling having suffered crippling mid-year cuts, there was an unprecedented feeling of doom and gloom during this year’s Beilensen Hearing inside the Board of Supervisors’s chambers.

The Beilensen Hearings, which the state requires when cuts are proposed to public health programs and services, have become an annual dance, which goes like this: first the Mayor proposes massive cuts, then the Board tries to restore funds, next competing rallies are held, and finally most of the programs are restored,

Only this year, there is little to no money to be found.

During his June 2 budget annoucement, Mayor Gavin Newsom pointed out that while the City is facing a record $338 million deficit, it is also is seeing healthy increases in tax revenues.

So, why such a massive imbalance this year? Newsom claims we are spending more than we are taking in, but that answer sidesteps the political reality of just why that is happening on such a greater scale, this year.

The answer to that question lies in two directions: Newsom’s approval, and the Board’s largely unflinching support (Sup. Chris Daly was the lone dissenting voice) for union contracts last summer, when the Mayor was up for reelection; and Newsom and the Board’s failure to introduce legislation last year to create new revenue streams to make up for the increasing slice of funds that those same union contracts, predictably, are swallowing up.

To their credit, Board President Aaron Peskin (who celebrated his birthday June 17, just as gay marriage mania was hitting City Hall big time) and Sup. Jake McGoldrick, who chairs the Board’s powerful Budget and Finance Committee, have now bitten the bullet and introduced legislation that seeks to increase property transfer taxes and close the pay roll tax partnership loophole.

But even if these measures are approved, (and that’s a big if, they won’t ease this year’s budget pains.

What could help, on a more immediate level, is the identification of significant savings within the Mayor’s proposed 2008-09 budget. And to that end Budget Committee chair McGoldrick has dug his claws deep into Newsom’s proposed budget document and drawn blood.

This blood letting began ast week, when McGoldrick led the charge against funding the Mayor’s proposed $3 million Community Justice Center. (The proposal got sent back to committee where it will likely fester, and the Mayor has responded by placing a measure on the November ballot that would allocate $1.8 Million in city funds and earmark an additional $984,000 in federal grant money to create the proposed center.)

And at yesterday’s Board meeting, McGoldrick told me that he has identified potential savings of $8-10 million from the San Francisco Police Department, including eliminating over staffing as well as defunding two out of the Mayor’s three proposed police academies.

“Any claims that they are understaffed are not true,” said McGoldrick, who says he came to this conclusion by factoring in 129 civilianized positions into SFPD staffing totals.

“And I’ve already told the Mayor and the Chief of Police that they are not going to get three police academies, and that the Mayor’s 311 Center is not getting 26 new positions,” McGoldrick continued. “We are going to have to figure out a more efficient way to run it. This is all about priorities. My priorities are the sick, the shut-ins, the elderly, children, the mentally ill and the victims of domestic violence.”

Meanwhile, Sup. Chris Daly extracted hollow laughs when he announced that he would not make the exact same speech as he did at last year’s Beilenson Hearing.

Daly was referring to his now infamous speech in which he referred to “allegations of cocaine use,”—allegations that were whispered around town, after it was revealed that Newsom had had an adulterous affair with the wife of his then campaign manager Alex Tourk, but that were never proven and thus would have been better left unmentioned in a public hearing that was seeking to illuminate Newsom’s wacky budget priorities..

But because Daly mentioned them, the media, which doesn’t like covering budget hearings, since there’s nothing sexy about covering hours of testimony in which people describe , over and over, the devastation that proposed cuts will have on their programs, happily refocused its lens on the alleged inappropriateness of Daly’s speech, thereby helping the Mayor get off the hook for proposing cuts to substance abuse treatment programs, in the same year he claimed to be undergoing alcohol abuse therapy.

Or maybe it was because that in this LGBT-friendly town, Newsom will always be remembered as the patron saint of gay marriage, and because of his sainthood voters will largely absolve him of all his other sins, including making decimating financial cuts to public health programs that have helped the LGBT community for decades.

Either way, this time around, Daly, (while complaining that the Beilenson hearing should happen in front of the Mayor), didn’t bother to imply that Newsom had somehow lost his moral compass.

Which was probably a wise l move, given that at that very moment the Mayor was being elevated to international renown for having pushed the gay rights envelope all the way to the wedding altar, at a time when the rest of the Democratic Party, fearing another four years of President Bush in 2004, was whimpering “too much, too soon, too fast.”

Instead, Daly commented that his district will likely look like “the Night of the Living Dead” once Newsom’s proposed budget cuts go into effect,

Daly also introduced the “Treatment on Demand Act,” which “requires that the City and County of San Francisco “maintain an adequate level of free and low cost medical substance abuse services and residential treatment slots commensurate with demand.”

Daly’s act measures demand, “by the total number of filled medical substance abuse slots plus the total number of individuals seeking such slots as well as the total number of filled residential treatment slots plus the number of individuals seeking such slots.”

But for now, it’s budget hearing season, and advocates like Bill Hirsch of the AIDS Legal Referral Panel are telling the Board how they believe the Mayor’s proposed cuts amount to “a dismantling of a system of care that has taken over 25 years to put together.”

“We’re terribly disappointed with the mayor’s Budget,” Hirsch said, against a soundtrack of whoops of joy as gay couples celebrated their weddings outside the Board’s chambers.
“Hopefully, the Board can help prevent the worst of this.”

Others, like Connie Ford of Office Employees Local 3, which represents 800 non-profit workers, called the 22 percent cuts that the Department of Public Health is facing, “the most chaotic, unstrategic and ill-advised cuts” she’d ever seen.
“We’ll hurt people and the cuts will actually cost us more money” Ford said. “There is no rhyme or reason to these cuts.”

FelicianHouston, program director of a Woman’s Place, said that the proposed cuts are a “reflection of the dismantling of the continuum of care.”
“Just don’t do it.” Houston said.

And the list of speakers went on and on, including representatives for suicide prevention, crystal meth intervention, and mobile assistance patrol programs.

“Studies show that for every one dollar spent on substance abuse treatment seven dollars are saved at the law enforcement level” said several speakers. It’s a comment that brings us full circle to the insanity of proposing to start new programs, like the Community Justice Center, while proposing to slash the programs that would serve that center.

Towards Carfree Cities: “We’re not doing enough”

“We’re not doing enough,” Gil Peñalosa told the Towards Carfree Cities conference during his keynote speech yesterday. Cities are facing multiple crises connected to over-reliance on the automobile – declining public health, environmental degradation, resource depletion, loss of community, not enough space in U.S. cities to handle the 100 million people they’ll need to accommodate in the next 35 years – and most are responding with baby steps that deny the scope of the challenge our species in facing.

Peñalosa is sort of a rock star among the carfree set. After spearheading the transformation of his native Bogota, Columbia into a healthy, forward-thinking community by overhauling parks and roadways and pioneering the carfree “Ciclovia” concept that San Francisco is now adopting, Peñalosa took to the international stage, serving as executive director of Walk and Bike for Life and working closely with pioneering urban design firms such as Gehl Architects.

Unlike many European cities that have aggressively moved beyond automobile-centered development models, Peñalosa said no U.S. city has demonstrated the political will to make carfree living a realistic option for all their citizens, particularly the very young and very old. He congratulated Portland for recently receiving the top-tier platinum designation for bicycle friendly cities from the League of American Bicyclists.

That’s very good, but he noted that it’s tough to go from good to great, which is what needs to happen now if we’re to slow global warming, reverse obesity trends, and prevent soul-sapping gridlock in our cities. “The reality is Portland is far from being great,” Peñalosa said. “You are only good. You’re far from being great.” He also commended New York City for announcing just a day earlier that much of Manhatten will be carfree for three days this summer. But again, good, not great.

San Francisco, by the way, is a tier below Portland’s platinum with a ranking of gold. Sure, we’re doing a Ciclovia for three days this August and talking about a congestion pricing fee for driving downtown (something New York City recently tried and failed to implement). But compared to cities such as Copenhagen, Amsterdam, Berlin, Paris, Vancouver, Barcelona, and Melbourne – where well over half of all trips are taken by foot, transit or bicycle and the populations are far healthier – San Francisco, New York City, and Portland are living in the last century. He said it’s time for the best U.S. cities to start playing at the level of their international counterparts.

“That’s where Portland belongs and that’s the challenge,” Peñalosa said. “Under existing conditions, we have to make major leaps instead of baby steps.”

Another shelter down

Inside the front door of the Marian Residence for Women, a small handmade sign by a former resident advises newcomers, "Don’t compare this place to any others."

But I’ve stayed in the city-funded homeless shelters, and after a night at Marian, it’s hard not to rave about the differences. I’m given an actual bed to sleep on, with freshly laundered sheets, blankets, and a pillow. The bathrooms and showers are clean, and I’m offered every toiletry I could possibly need — as well as pajamas. Dinner is a wholesome meal of turkey, potatoes, and steamed greens — not the mystery meat on Wonder bread I received at the city’s MSC South shelter.

And unlike the tension I’ve witnessed at other shelters, the atmosphere inside Marian is close to pacific. After dinner, the 29 other women shower, read, rest on their beds, work on their laptops, or talk quietly while sitting at small tables in the common area. After my mandatory shower, I sit with an employee who explains the rules — be respectful of others, no drinking or drugs, and don’t forget to do my chore, which is assisting with dinner service. As long as I’m home by 7 p.m., I can have my bed as long as I need it.

That is, she clarifies, until the end of August — when they’re closing the shelter. For good.

Marian is a casualty of a plan by St. Anthony Foundation to cut $3 million from the foundation’s operating budget. In addition to closing the $1.2 million Marian facility, which houses 30 women in the emergency shelter and 27 in a transitional program, St. Anthony also will shutter its 315-acre organic dairy farm in Petaluma, currently used as a rehabilitation program for homeless addicts. Its Senior Outreach and Social Services [SOSS] is also losing staff and office space as it consolidates with the Social Work Center.

Five of the foundation’s 11 programs face cuts, the result of a two-year sustainability study that St. Anthony’s executive director, Father John Hardin, said will keep the charity out of a fiscal tailspin.

"We’re not in a financial crisis," he told the Guardian. "The reason we’re doing this is so we won’t be in a financial crisis."

He said the closures reflect the organization’s desire to get back to basics.

But, as one of the 40 soon-to-be-laid-off employees said, "They’ve said they want to refocus on basic services, but I see shelter as a basic service."

St. Anthony receives no city money for the work it does, but the closures are occurring in what’s already a war zone of budget cuts for social services in San Francisco. The loss of any of St. Anthony’s programs affects the city as a whole.

"Are we concerned? Yes," said Dave Knego of Curry Senior Services, which frequently refers seniors the group can’t help to St. Anthony’s SOSS program. "Unfortunately, we already have a waiting list, and the city’s cutting our funding back by 10 percent."

The closure of Marian is yet another sign of the slow erosion of shelter space in San Francisco. Since July 2004, 364 shelter spots have disappeared. By the end of August, Marian’s 57 beds and Ella Hill Hutch’s 100 mats will be gone as well. "You can’t afford to lose 57 beds, especially in a place where women are being treated like human beings," said Western Regional Advocacy Project’s Paul Boden, who’s worked with homeless services in the city since the 1980s. "What I thought was really ironic was there wasn’t any attempt to build a community effort to discuss how to save this facility. These beds are an incredibly important community resource."

Some of the women who live in the transitional program at Marian wanted to rally and save the shelter. "First and foremost was to try to save Marian Residence for Women," said Leticia Hernandez, a two-year resident of the transitional program who still hasn’t lined up a place to go when the shelter closes. "Even if we couldn’t save it, we thought it was still worth a try because any money that would come would go back to them." The women drafted a letter asking for help, which they’d hoped management would distribute to the press and public.

The foundation, Hernandez said, had a "thanks, but no thanks" response.

Hardin told us that St. Anthony’s wasn’t facing a financial crisis, so "we’re not going to get up and cry wolf. We want to go back to some of the basics. We’re turning people away from the clinic," he pointed out.

He agreed that shelter was a basic service, but said, "We can’t do it all."

The foundation wouldn’t detail its intentions for the building once it’s vacated Aug. 31, beyond affirming that it would be rented. "That’s going to be an income generator," said foundation spokesperson Francis Aviani. "We are hoping to get a social service agency to use the space in the way it’s designed for, helping folks."

Multiple St. Anthony employees said they were told the facility would be used for medical respite — beds set aside for people who aren’t in critical condition, but are too ill or fragile to mingle with the general population and have nowhere else to go — and a St. Anthony board member confirmed that was the only plan presented to the board.

Marc Trotz, director of the San Francisco Department of Public Health’s Housing and Urban Health division, which oversees its $2.5 million, 60-bed medical respite program currently housed in two facilities, told us the city is looking for a new respite site. He confirmed that the Marian building is a facility the agency has seriously considered. "We’re not looking to push one program out in favor of another or anything like that." But, he said, "It’s a potential site that would work well."

While St. Anthony is cutting $3 million in programs, foundation staffers have been working for several years on a $22 million capital campaign for a new administrative building at 150 Golden Gate Ave. The building will replace a facility at 121 Golden Gate, where offices, the clinic, an employment center, and a dining room are currently housed. The popular dining room — which serves 2,600 meals a day — will ultimately move back to 121 Golden Gate after the building is razed and rebuilt to meet modern earthquake safety standards. The project is part of another $20 million campaign that includes a partnership with Mercy Housing to build affordable rentals on the upper floors.

St. Anthony staffers say the types of donors who will contribute to a new building are very different from those who will fund ongoing programs.

Meanwhile, food costs in the dining room have increased 18 percent in the last three months, and St. Anthony staffers expect another 25 percent increase during the coming quarter. At the same time, other free food programs in the city have closed, which means St. Anthony is seeing new faces in the dining room.

Aviani confirmed that donations have increased 8 percent to 10 percent, but the group receives very few "unrestricted" funds. Most of the money is earmarked for the dining room. In a way, she said, "that’s the community deciding what they want."

A third of the organization’s $19.7 million budget comes from bequests — a form of donation that has waxed and waned in recent years. According to Aviani, the foundation has yet to receive a single bequest this year.

The group has increased grants and deployed new fundraising methods, but she said that "The amount of grants out there for shelters and women’s programs are few and far between." She acknowledged that shelters are needed, and said St. Anthony has been "pretty outspoken about that."

The foundation has kept a tight lid on talk about the closures. None of the employees contacted by the Guardian would speak on the record — for fear, they said, of losing their severance packages.

Aviani said severance packages — which include pay and personal job coaching — are not on the line. "We asked them not to create a gossip chain, to stay focused on their work, and when people have questions, direct them to me. We didn’t say they couldn’t talk to anyone at all. That wasn’t the message at all."

Whether or not the gag order was intentional, it has had an effect and created suspicion about the foundation’s true intentions.

Even the city deferred to the organization when questioned about the potential plan to rent the Marian building and use it as a medical respite facility. "We’re not going to talk about that," said DPH spokesperson Eileen Shields. "We’re going to let St. Anthony talk about that at this point because it’s St. Anthony’s call."

On Feb. 14, Newsom — who has said shelters don’t solve homelessness — announced he would like to redesign the city’s shelters and called on the community to come up with suggestions. One of his specific suggestions was to create more medical respite centers.

In May, the Local Homeless Coordinating Board, which is chaired by Hardin, released a report outlining a number of detailed suggestions for improving city-funded shelters and services. It specifically stated that shelter beds shouldn’t be sacrificed to make room for respite.

The Mayor’s Office has yet to formally respond to the report, but at the June 2 LHCB meeting, Kayhan said there were a few things he felt confident the mayor would endorse.

"We heard loud and clear: more senior beds," Kayhan said. "And I’ll add to that women’s beds." He said that respite care would be "moving and co-locating with another location. We think that could free up space at one of the shelters." And, he added, that space could be allocated to women or seniors.

Which makes it sound like more beds for women and seniors are in the works — but considering the elimination of Marian and a shelter at Ella Hill Hutch Community Center, the city is still looking at a net loss of places for the homeless to sleep at night.

Board member Laura Guzman, who runs the Mission Neighborhood Resource Center, said she heard Hardin announce the Marian closure at a May 5 meeting. "He said it was a very difficult decision. I believe he said we’re going to try to open some medical respite beds," Guzman said. "All along we’ve said we don’t want to replace shelter with medical respite beds, but that’s exactly what’s happening."

Shuttering Marian is just one more loss in an environment of dwindling resources for women. Buster’s Place, the only 24-hour drop-in center for men and women, closed in March, and was replaced by a smaller facility that only allows men.

Five of the city’s other shelters have sections for women, but one of them is slated to close as well and none can offer a women-only safe space like Marian. A Woman’s Place is the only other all-female facility, and its 15 mats on the floor are always full. "With Marian closing, there’s going to be more of a demand on the total system," said Janet Goy, executive director of Community Awareness and Training Services, which runs A Woman’s Place. "It’s a loss, no question."

Emily Murase of the Commission on the Status of Women said it’s difficult to accurately count homeless women because women tend to take more measures than men to stay off the streets, though they may not necessarily be safely housed. Women are more prone to couch-surf, stay in abusive relationships, or settle for some other kind of compromised situation.

Murase’s group now funds a special women-only program at Glide Memorial Church, whose director, Willa Seldon, said, "We’re certainly seeing an increase in volume of women in the city to our programs. In October, we were seeing 11 in our support groups. That increased to 18 by March. It could definitely be related to Buster’s Place closing."

Hardin acknowledged the need for women’s shelters but said the city ought to take on the burden. "Maybe closing the Marian is a tipping point," he said. "As I said in front of the Board of Supervisors, it’s the government’s responsibility to provide the safety net. We’re the hands beneath the safety net."

Sandy Van Dusen has been living in the transitional program for a year and a half since her husband was murdered. She’s been told that she is about to get a studio apartment. She’s visibly excited about the move, and grateful to the foundation. But, she says, she’s still been crying every day since she heard Marian is closing. "They saved my life," she says, crying a little now. "They’re doing what they told me to never do — throw in the towel."

To surcharge, without love

OPINION With the first linen pants of 2008, this city commenced collecting employer contributions to the Healthy San Francisco universal health care program. Employers that don’t provide insurance now must pay the city for the public health care their employees use anyway. A number of restaurants have added "Healthy San Francisco" surcharges of 2 to 4 percent to diners’ tabs. These surcharges are at best sour grapes and at worst a diabolical plan to thwart democracy.

Present spite notwithstanding, I spend all my discretionary income on dining. My economic stimulus check stimulated some duck confit and tarte tatin. I’d trade a kidney for dinner at Coi. My disaster preparedness kit includes a Zagat Guide. The stokers of my culinary flame deserve to be treated well. Our restaurant scene should attract the best, the brightest, the most ingenuously-tattooed epicureans. The people of San Francisco deigned to achieve this noble goal by providing a higher minimum wage, paid sick leave, and now universal health care. Oh, the decadence! We’re drifting dangerously close to becoming a civilized society, which could get us invaded. Don’t be surprised when Blackwater goes hunting for Tom Ammiano in a spider-hole.

Some disgruntled restaurants have decided to assess a surcharge rather than raise prices. But all prices fluctuate. When the cost of electricity or halibut goes up, menu prices rise. Regulation affects cost. We knew that when we passed the laws. A surcharge instead of a menu price increase is restaurant owners’ way of saying that workers are less valuable than halibut.

Let them have health care. I enjoy clogging my own arteries so much more when the people feeding me get their cholesterol checked.

Owners claim their profit margin can’t absorb higher labor costs, hence the price hike. Restaurants have high failure rates and run a tight margin.

But raising prices wouldn’t be Armageddon for fine dining in Baghdad by the Bay. Heck, it’s not even Shock and Awe. Maybe I’d notice if Bar Tartine raised prices by 4 percent. Maybe I’d be annoyed. But if my $60 meal became $62, I wouldn’t head to a taqueria. The amount surchargers would have to jack prices before surchargees stay home is quite high. Most of us eating at Bar Tartine can suck it up like so many amuses bouches.

San Francisco Chronicle critic Michael Bauer is wont to blame every restaurant closure on our labor largesse. But restaurants fail for any number of reasons. Could be labor costs, or it could be that Bauer panned them, or that their concept, food, and location were bad, or that the manager was on coke.

Some restaurateurs can’t abide the people of San Francisco reguutf8g them. But that’s life in a democracy. The same people excusing the surcharge as mere kindly consciousness-raising are currently appealing the Healthy San Francisco law. In fact, the Golden Gate Restaurant Association opposes any improvement in labor standards. The folks there hope that diners, our fury stoked by surcharges, will finally rebel against our labor-loving local legislators, stop imposing our so-called values on restaurants, and demand to be served by disease-ridden, malnourished indigent waiters as God and Milton Friedman intended.

Instead of an irascible surcharge, menus could note: "Our food is organic, local, and sustainable. And the cook gets his asthma treated." People who care will be happy, and people who don’t will blithely resume checking the NASDAQ on their iPhones.

So quit grousing. Enjoy the short ribs. See your doctor. Everybody wins. *

Environmental shake up

GREEN CITY Nothing mobilizes community action like a natural disaster. When the big one hits San Francisco, everyone from the city’s Neighborhood Emergency Response Teams to informal groups of resourceful and community-minded individuals will fly into action to tend the wounded, free the trapped, feed the hungry, and rebuild the community.

When the situation calls for it, San Franciscans have demonstrated over and over again a remarkable capacity for selfless and almost superhuman action, from the earthquakes of 1906 and 1989 to last year’s outpouring of support for the cleanup effort after last year’s big oil tanker spill in the bay.

So why aren’t we bringing that same resolve and community resourcefulness to global problems like climate change, rapid depletion of natural resources, persistent poverty and warfare, declining biological diversity, and the myriad threats to public health? That’s the question being posed at a groundbreaking grassroots event this weekend in Golden Gate Park.

The Big ONE Convergence 2008, scheduled June 21 and 22 from 9 a.m. to 7 p.m., is sponsored by The Big ONE movement, which formed in the wake of San Francisco’s World Environment Day in 2005. The group was inspired by the idea of "the big one," or a massive earthquake, because the goal of the movement is to affect everyone in much the same way that a natural disaster of that size would.

"We emphasized the tectonic idea because tectonic shifts are big," said Sudeep Rao, an event organizer. "We need to make big changes. It can’t just be about light bulbs and shorter showers. We can’t think that’s all we need to know."

Members of The Big ONE have been meeting on a monthly basis and discussing sustainability ideas since 2006. Their home base is a Web site called www.beautifulcommunities.org that is organized into various "neighborhoods." The groups examine issues such as health, housing, social justice, economic justice, energy, and sustainability.

The Big ONE movement is just one part of Beautiful Communities, and this weekend’s convergence includes a massive potluck in between learning how to do everything from building a solar oven to teaming up with a local organic farmer to deliver fresh food to schools.

Event co-chair Tori Jacobs said there are more than 7,500 nonprofits in the San Francisco Bay Area, 3,800 of which deal with sustainability issues. One goal of the convergence is to bring these groups together so they can collaborate.

"So much work is being duplicated, and our efforts need to be collaborated," she said. "The only way to do that is to get to know each other and to dialogue about how we can help each other."

Jacobs said there will be hundreds of nonprofits at the convergence and the intention is to have them all meet, coordinate, and move forward together. There will be break-out sessions from 5 to 6:30 p.m. both days, allowing the general public to meet and brainstorm ideas about community on Saturday, and giving representatives of the nonprofits a chance to meet with one another on Sunday.

"The one thing [The Big ONE participants] said is, ‘Let’s make this event the starting point,’<0x2009>" Jacobs said.

To act on the ideas generated at the convergence, the Peaceful World Foundation has agreed to let participants use its headquarters in San Francisco as a weekly meeting place to hold revolving town hall meetings and gatherings. Rao said the event is about bringing like-minded people together.

"We’ve lost that sense of collective empathy and urgency about what needs to be done," Rao said. "We are inspired, and we want to help others be inspired. We believe in Dr. Martin Luther King’s assertion that the tranquilizing drug of gradualism is unacceptable."

Rao said relying on the commercial and governmental systems to solve pressing global problems through science and technology is a leap of faith that the people shouldn’t be willing to make.

"They do have a large role solving our problems," Rae said, but without collective and individual efforts to bring about change, leverage skills, and pressure governments, the will to take big steps just won’t be there. That requires a convergence like The BIG One.

"Everyone I have spoken with has resonated on that aspect," he said. "They say, ‘Yeah, I want to go and meet individuals face-to-face and build that trust.’<0x2009>" *

Mayor Gavin Newsom chose a telling site for the June 2 release of his budget: the San Francisco Police Department’s Special Tactical Operations Center at Hunters Point Shipyard. And if its relationship to Proposition G, the mayor’s plan to let Lennar Corporation develop the southeast part of the city, wasn’t clear enough, Newsom made it explicit.

"You’ll have the opportunity to support Proposition G and reject Proposition F, the one that is getting in the way," Newsom told department heads and the press as police, who warned budget protesters that it is illegal to campaign on city property, looked on in silence. It is also illegal for the mayor to campaign for ballot measures on city property.

In his speech, Newsom labeled as the "heroes" of this year’s budget the unions that have agreed to unpaid days off, including the Laborer’s Union, the Deputy Sheriff’s Association, Firefighters Local 798, and the Municipal Executives Association. Conversely, he vowed to remember that the police, nurses, and lawyers unions wouldn’t amend the contracts Newsom negotiated last summer.

Sounding more like a gubernatorial candidate intent on winning over Orange County voters than the leader of the most progressive city in the nation, Newsom said, "We are living within our means and being fiscally prudent, without out-of-control borrowing and without tax increases. But we still have a $338 million shortfall."

But there has been widespread criticism of the mayor’s plan as details emerge of its massive cuts to health and human services, while increasing the city’s budget for street repaving, pothole repair, and police academies.

"It’s the least democratic, least transparent budget process in many years, in terms of lack of information from the Mayor’s Office to the city departments and the community-based organizations that are affected," said Coleman Advocates for Children and Youth organizer Chelsea Boilard. "In the past, programs were given a heads-up. This year it continues to be a frantic scramble."

According to Boilard, city departments were still finding out the extent of the cuts even after Newsom made his presentation, including the news that the budget addbacks approved by the Board of Supervisors last year are not being continued in the 2008-09 budget.

"A nightmare," was how Debbi Lerman of the San Francisco Human Services Network described the budget.

"If we listen to mayor’s presentation, everything is rosy, revenue-wise. It’s just a spending problem. But from the community’s perspective, it’s shocking," Lerman said, citing $15.5 million in cuts to the Department of Public Health, $3.5 million in cuts to the Human Services Agency, and a 20 percent cut to domestic violence programs.

"And [the cuts] have been a constantly moving target," Lerman added. "We’re mere weeks away from the implementation of this budget, but no one knows which clients, programs, or services will be lost, though we are sure that there will be a lot of layoffs in our sector. The mayor should not balance his budget on the backs of the poor."

She believes the city needs to look at some non-essential services during a bad budget year and see what can be deferred to the future — and find ways to increase its revenue.

"The mayor is not a stone. He does get it to some degree. But it’s unfortunate that he’s not chosen to put forth revenue measures at this point," Lerman said.

Robert Haaland of Service Employees International Union Local 1021 agrees that the city has a revenue problem. He also believes that it’s not OK to ask the city’s lowest-paid workers to make concessions, again and again: "[SEIU 1021] has repeatedly stepped up to the table, we’d like to see some others do it."

Jonathan Vernick, executive director of Baker’s Place, which is facing the prospect of having to close one floor of its medical detox program, argues that many of the mayor’s proposed cuts are in conflict with Newsom’s stated goal of getting the homeless and inebriated off the street. "Ironically, this budget seems to fail to meet a simple criteria — that the proposed cut actually saves money," Vernick said. "All I can see is cuts that by end of fiscal year will have dismantled a system that’s been working for 35 years."

John Eckstrom of the Haight Ashbury Clinics believes the budget cuts will decimate the model of integrated services. "These are very deep cuts," said Eckstrom, who expects to lay off 40 to 50 of his 170 employees.

"It’s a testament to the willpower of the nonprofits that we are able to stay alive," Eckstrom said. "But what are the mayor’s priorities? There’s his rhetoric that says it’s not a revenue problem, and then there’s the reality."

With the Board of Supervisors set to conduct public budget hearings throughout June, Board President Aaron Peskin sees Newsom’s proposal as a "law and order budget."

"Domestic violence programs have lost $750,000 in funds, substance abuse programs have been taken to the woodshed, and mental health programs are being cut by 25 percent," said Peskin, criticizing the mayor for "introducing and extolling new programs while failing to protect the safety net of human and health services that San Francisco has put together over many years."

"Last time we had a budget like this, Mayor Willie Brown was much more forthright and honest about its disastrous impact on the poor," Peskin added. "This administration has cloaked this disaster in a press blitz. But any way you dress it, it’s a pig."

As chair of the Board’s Budget and Finance Committee, Sup. Jake McGoldrick was equally blunt in his criticisms as he set about deciphering the details of Newsom’s proposal

McGoldrick refuted as "a deception" Newsom’s claim of having cut 1,085 jobs. "The real number is 99.08 positions," McGoldrick said, factoring in preexisting vacancies, Newsom’s three proposed police academy classes, and the 26 staff positions for Newsom’s 311 program, not to mention other new proposed programs and initiatives.

Upset that Newsom has budgeted $500,000 for a Community Justice Court that will divert people to the kinds of programs that Newsom’s budget is undermining, McGoldrick told the Guardian that he "aims to identify at least $30 million to $40 million in deceptions and redirect these funds to top priority human needs and services that are already woefully underfunded."

"The mayor is trying to pump all the problems over to the Board of Supervisors," McGoldrick said. "It’s going to be a labor of love to figure out how to direct money to folks who are hurting now."

Peskin said he expects the supervisors to discuss three new revenue proposals in the next month in order to avoid another slash-and-burn budget next year. These proposals include a property transfer tax, closing a payroll tax loophole on partnerships, and preserving the city’s 911 fee, which is under legal attack.

As of press time, the Mayor’s Office had not returned calls about revenue creation. Maybe Newsom’s handlers were busy figuring out how to deal with a budget protest slated for 6 p.m. June 11 outside the his residence in the Bellaire Tower building, 1101 Green St.

Organized by Jennifer Friedenbach, executive director of the Coalition on Homelessness, the protest aims to draw attention to what Friedenbach calls "Mayor Newsomator’s plans to terminate the poor."

These plans include closing the Ella Hill Hutch Homeless Shelter as well as the Tenderloin Health Homeless Drop-in, and the almost total elimination of the SRO Families United Program. The Board has until July 31 to adopt a revised budget.

Beyond the budget spin

OPINION Local government is frozen. The mayor’s office and the Board of Supervisors have been engaged in open warfare for months. This week, Mayor Gavin Newsom announced that in order to balance San Francisco’s budget, city services and community-based organizations will have to undergo draconian cuts.

In a preemptive move against embarrassing protests, the mayor’s press office did not reveal the location of the annual budget presentation to the news media until late Friday afternoon. Even the supervisors, who will be debating and voting on the budget during the month of June, were left in the dark until then.

While the mayor didn’t blame city workers for the financial crisis, he did suggest that Service Employees International Union Local 1021, which represents the low-wage, frontline, service-providing city workers, should "help out."

Well, we have. SEIU members stepped up to "help out" in fiscal years 2003–04 and 2004–05 by agreeing to wage freezes and self-funding our pensions. All the recent midyear cuts were in public health agencies and among SEIU-represented nonprofits.

Most recently we stepped up by helping draft and vigorously campaigning to pass Proposition B, which freezes city workers wages for two years and tightens eligibility for retiree health care benefits in exchange for a modest increase in city pension benefits.

The mayor’s budget director repeatedly has said that this is a spending problem, not a revenue problem. Talk about spin.

Moreover, in his June 2 budget presentation, the mayor made no mention of raising revenue as an answer to our fiscal problems. You could almost hear Gov. Schwarzenegger’s voice as Newsom presented a slash-services budget with a "no-new-taxes" slogan waiting in the wings for his next campaign.

Everyone knows it’s expensive to live in San Francisco. Paying city employees a wage that allows them to stay in the community they serve isn’t a budget "problem." It ought to be a basic part of what City Hall does and cares about. And if that means looking at bringing in new sources of money, we should have that conversation.

We believe there are various revenue sources that make more sense to explore than some of these service cuts, including a real estate transfer tax increase for high-level properties.

Fortunately, the mayor’s proposal is just a starting point. Soon we will be proposing specific alternatives.

Toward that end, the San Francisco Human Services Network and Coleman Advocates for Children and Youth have organized a citywide forum on the mayor’s proposed budget cuts. SEIU 1021 is cosponsoring this event. The San Francisco budget and revenue town-hall meeting will be held June 9 from 2-4 p.m. in the San Francisco Main Library’s Koret Auditorium, 100 Larkin (at Grove)

GREEN CITY At long last, the San Francisco Public Utilities Commission appears to be moving forward with plans to address long overdue environmental justice issues (“It Flows Downhill,” 08/08/06) that are directly related to its sewage treatment plant in the city’s southeast sector.

At a May 27 SFPUC meeting, SFPUC staff recommended that the agency build a new digester facility in the southeast part of town and divert 12 percent of its sewage flow to the west side’s Oceanside plant, (which, incidentally, a current signature-gathering campaign hopes voters in November will rename the George W. Bush Sewage Treatment Plant).

For decades residents of Bayview–Hunters Point have endured foul smells, thanks to the close proximity to their homes of the Southeast treatment plant. The site treats 76 percent of the city’s sewage in facilities that are almost entirely outdoors. By contrast, facilities at the Oceanside plant, in a wealthier side of town, are mostly indoors and/or underground.

It’s an unequal division that has long had southeast residents claiming environmental racism. To make matters worse, the Southeast plant contains nine pancake-shaped digesters that could experience problems in an earthquake, with worrisome corrosion on the undersides of the digesters’ covers.

Cost estimates for a new digester facility range from $700 million to $1.3 billion. This variation depends on the location choice for the new digesters: if the agency builds new digesters on the south side of its existing Southeast plant, the agency is looking at the cheaper end of the scale.

But if the SFPUC follows another option to build a new facility on the back lot of Pier 94, a Port of San Francisco property, it would remove the plant from a residential neighborhood but be left facing a near doubling of the cost.

Replacing the digesters was a pet cause of former SFPUC General Manager Susan Leal, and continues to be a priority for District 10 supervisor Sophie Maxwell, so it’s likely to remain a key focus for former City Controller Ed Harrington, who took over as general manager of the agency after Mayor Gavin Newsom ousted Leal.

"You’ll see immediate work on the digesters," Harrington assured the commissioners. "The PUC is suggesting doing on an environmental impact report on both sites."

That report likely won’t be complete until 2010, when the agency leaders will have to choose an option. PUC project manager Jon Loiacono seems to be keenly aware of the thorny issues at play and told the commission that "staff would like to work with an advisory group and hire a consultant sensitive to community issues to find the best solution."

"It would almost certainly be less expensive to rebuild on the current site, but we don’t want anyone to make the digester decision based on cost," PUC spokesperson Tony Winniker told the Guardian.

"We really want it to be a public health and safety decision," PUC Citizens Advisory Committee chair Alex Lantsberg told the Guardian.

The digester replacement cost represents a significant chunk of the total estimated price tag of the PUC’s proposed sewer system master plan, which ranges from $3.8 billion to $4.4 billion. PUC staff is also outlining plans to send some of the waste westward in what the PUC currently calls "the Upper Alemany diversion."

The plan involves building a tunnel near Cayuga Creek, where runoff water tends to back up, and carrying it to the Oceanside plant. So, is this the return of the dreaded cross-town tunnel, an idea that had irate Bernal Heights residents waving plungers at City Hall three decades ago? PUC staff claim it is not.

"It’s a different concept, but similar," Loiacono said of the current plan.

"This reduces how much waste is treated in the Bayview and shifts it to a plant where there is excess capacity," Winniker explained, further noting that while the old cross-town tunnel would have run under Bernal Heights, this diversion will use city rights of way.

The project would improve drainage for the Cayuga and divert about 10 million gallons of sewage per day from the Southeast plant to the Oceanside plant, PUC spokesperson Tyron Jue told us. The alignment hasn’t been chosen yet, but Jue said, "we’re considering different routes, like Brotherhood Way or Ocean Avenue."

Whatever path the SFPUC pursues, the project won’t be cheap — economically or politically.

I was having lunch with an old friend the other day, and, as usual, we got through our lives and kids pretty quickly and wound up talking about tax policy. I’m a great date.

I was explaining to her — well, yeah, I was lecturing, at some volume — about the problem with sales taxes and the value of parcel taxes and income taxes, and somewhere along the line I realized that the progressive leadership in San Francisco needs to think a bit more about small business.

See, my friend’s husband runs a small company, and she isn’t happy about the way the city’s universal health plan is financed. "If this is so important to San Francisco," she asked, "why aren’t we all paying for it, instead of just businesses?" Her idea: finance the program with a new sales tax.

Well, I support Healthy San Francisco and I think that, all things considered, Sup. Tom Ammiano did an amazing job of putting together a plan that is actually working. Ammiano told me last week that more than 20,000 people — formerly uninsured people — have signed up. This is a very big deal.

I realize it’s also a pain for a lot of smaller businesses, in part because the rules — specifically designed to keep unscrupulous employers from cheating — are complicated and hard to follow. And for companies that are barely making it, the tab for insurance can be brutal.

That, of course, is the overall problem with employer-based health insurance. But it’s the system we’re working under, and the complexity of creating a completely different model in one city would be, to say the least, daunting. In fact, there were a lot of employers in this city, many big retail outlets and national chains, that could well afford to pay for employee health insurance but instead dumped their workers on the overburdened public health system.

And restaurants, which are whining the loudest, have managed to stick their customers with the added cost, which frankly isn’t such a terrible thing: people who eat out a lot can afford an extra buck so the kitchen help can see a doctor when they’re sick.

And as I (ever-so-gently and quietly) explained over my $12 sautéed prawns, sales taxes are horribly regressive, even worse than small-business taxes. I’m right; she’s wrong. We had a hell of a lunch.

But I think her frustration ran a bit deeper than this one issue, and I hear it from a lot of others too: small businesses don’t seem to be part of the progressive coalition.

I understand why: a lot of small business people are conservative, particularly on fiscal issues. It’s really annoying how often small merchants side with the Chamber of Commerce and the big downtown forces. You can’t get small business groups to support any new revenue measures.

And the progressive supervisors have done a lot for small businesses — starting with enacting limits on chain stores, which have protected locally owned shops in several commercial districts.

There’s a lot more we can do: I’m still pushing for a progressive business tax (cut taxes on the bottom, raise them on the top). And a city income tax would pay for health insurance and a lot more.

But right now, many community merchants are feeling ignored, and our next progressive candidate for mayor needs to think about that. It’s a potentially powerful constituency — but for all the wrong reasons, it’s going in all the wrong directions.

The Assembly Agriculture Committee passed two pieces of legislation today authored by Assemblymember John Laird (D-Santa Cruz) and related to the Light Brown Apple Moth controversy.

“We need to back up and walk through each outstanding issue in a science-based, clear way using neutral third party experts,” said Laird, who has been dealing with the LBAM furor since last summer, and has one of the best website’s in terms of tracking the progression of arguments and lawsuits related to the moth.

So, just what will Laird’s legislation do?

ACR 117, an Assembly Concurrent Resolution, calls on the California Department of Food and Agriculture, the Department of Pesticide Regulation, the Office of Environmental Health Hazard Assessment and other relevant state departments to address unresolved health, scientific and efficacy issues surrounding the CDFA’s Light Brown Apple Moth (LBAM )eradication plans.

The resolution passed 5-3, and next heads to the Assembly Appropriations Committee.

“It is the responsibility of our government to demonstrate its LBAM actions are necessary and do not compromise human or environmental health,” said Mr. Laird. “It isn’t the responsibility of the people to demonstrate the reverse.”

AB 2763, the Invasive Pest Planning Act of 2008 – would require the CDFA to create a list of invasive animals, plants, and insects that have a reasonable likelihood of entering California for which an eradication program might be appropriate.

For each invasive on the list, the department would prepare a written assessment on the most appropriate method of eradication. If pesticides were to be used, the assessment would have to discuss application methods, the chemistry of the pesticide and its inert ingredients, impacts on public health and the environment. If a pest was found, the department would have to notify various local agencies, hold public hearings, and comply with other requirements. The bill passed by a vote of 8-0 and next heads to the Assembly Appropriations Committee.

“The California Food & Agriculture’s Light Brown Apple Moth program has led to more contacts with my office than any single issue during my time in Sacramento,” said Laird. “Clearly, the state was not adequately prepared for LBAM. This bill aims to put in place a pest planning process that prevents the kind of public fear and confusion we’ve experienced with LBAM.”

Whether any of these efforts will succeed in derailing the feds’ trade agreement-driven plan to spray for the moth this summer in Santa Cruz, Monterey and the BAy Area counties remains to be seen.

Leno, Migden, and the Newsom cuts

EDITORIAL The closure this week of the venerable Haight Ashbury Food Program, which for more than a quarter century has served hot meals to hundreds of people a day, is another bitter reminder of what a rotten time it is to be poor in San Francisco.

Mayor Gavin Newsom’s approach to the city’s budget problems is to cut programs that serve the needy: Buster’s Place, the city’s only 24-hour drop-in center for homeless people, is closed. The public health nursing program is shutting down. Frontline city workers are getting laid off, and jobs will go unfilled. And there is no talk in the mayor’s office of any sort of comprehensive plan to raise new revenue to close what has become a structural budget gap of more than $300 million.

Yes, a big part of the fault lies in Washington DC and Sacramento. The federal government has abandoned American cities. The state is wracked with its own paralyzing budget problems (caused in large part by Gov. Arnold Schwarzenegger’s decision to eliminate the vehicle license fee). So money that San Francisco used to get without any direct effort — that is, without asking local residents and businesses to pay for it — is gone. And while San Francisco’s representatives in Sacramento have worked hard to win back money for cities and force the governor to moderate his cuts, the fact is that it’s unlikely San Francisco can count on any outside help during the next few years. The ugly budget choices have to be made at home.

That’s why it’s critical that every progressive leader in town be willing to take on the mayor’s brutal budget cuts and push for humane alternatives. That includes the two people running in a highly contested race for state Senate.

Carole Migden and Mark Leno are both seeking progressive support in the June primary. Both have good cases to make based on their records. But we need to see more than just good votes (and good legislation) in the state capital; like a lot of voters, we’re also looking to see which candidate will use the powerful seat and its bully pulpit to promote progressive values in the city.

Both candidates have long connections to the powerful forces that seek to balance the budget on the backs of the poor. Migden is close to Don Fisher, the Republican who pours huge gobs of money into regressive local measures and candidates. Leno has been endorsed by Newsom.

But with the election less than two months away, we’d like to hear both of them say, loudly and publicly, that the Newsom cuts are wrong and unacceptable, that the budget pain should be shared by the wealthy, and that the city needs to look at new taxes before it eliminates any more programs for the needy.

So states a recent California Department of Food and Agriculture press release, as the state seeks to allay public outcry in face of an impending deadline to begin aerial spray for the Light Brown Apple Moth.

The press release quotes California Association of Professional Scientists President Patty Valez saying that, “The report released by the joint health departments revealed that there is no link between the Light Brown Apple Moth spraying program and reported symptoms. In fact, it underscores the importance of a sound scientific evaluation in what has turned into a controversial but important aerial spraying program.”

The press release quotes Monterey Farm Bureau President Jason Smith saying, “IIf unchecked, the moth would damage native plants and would undermine our efforts to reduce pesticide use and improve water quality. It would raise international trade restrictions, erecting barriers to our farm exports and further weakening our rural economy.”

The release even draws on today’s Chronicle, which observes that “the state study noted most of the reports – even those requiring medical attention – were consistent with rates of common respiratory problems.”
But the release doesn’t report the reaction of Assemblymember John Laird, (D-Santa Cruz) whose district was sprayed last fall.

Maybe that’s because of Laird’s scathing response to the LBAM health affects report issued by the state Office of Environment Health Hazard Assessment, the Department of Pesticide Regulation and the Department of Public Health this week.

“I’m disappointed that what should have been a very serious scientific effort started long ago, became an exercise where just 10 percent of the reported cases were analyzed and the findings have been used effectively as spin for the CDFA,” Laird observed.

The CDFA did not mention that the California Organic Farmers no longer supports the spraying.

“To say that there is no information to indicate a link between the spraying and health affects is not the same as saying there is no link between spraying and health affects. The state did not reach out to a single doctor for the report. At a minimum, the reports associated with doctors should have been retrieved and given full analysis, including speaking with the reporting physicians.”

The 100-yard diet

GREEN CITY Locavorism — the practice of eating only or mostly food raised with a 100-mile distance — has been a hot trend the past couple of years. It’s a concept that makes a lot of sense — even organic food grown hundred or thousands of miles away can hardly be considered sustainable once you figure in the resources used to ship it.

But a committed breed of urban farmers is challenging even the 100-mile definition of local food. These folks are cultivating their own cornucopia in their backyards and community garden plots, pruning their own fruit trees, raising their own chickens….

Hold on a minute. Chickens? In the city?

It’s true. Not only is it possible to raise your own small brood (four or less) in San Francisco, but it’s less labor intensive and materially more rewarding than caring for your household pets. Do you need to take a chicken out for walks? No. Does your Chihuahua lay eggs? No.

And you can expect to reap more than just eggs from your new feathered friends. As Walter Parenteau of the Panhandle puts it, "Chickens fill an important spot in the cycle of a sustainable backyard." From their nitrogen-rich manure (an excellent catalyst for compost) to their enthusiasm for pest control, chickens earn their keep — even without the dozen eggs a week you’ll get from each pair of first-year layers.

A major issue for raising chickens in your backyard is space. In San Francisco, the city’s Department of Public Health requires that chicken coops be situated at least 20 feet from all buildings — which rules out keeping chickens on your patio or in your living room. Chickens also need space to thrive in: their run should ideally provide a minimum of four square feet per chicken and include a predator-proof covering of chicken wire or nonmetallic "poultry netting," which also will prevent escapees (contrary to popular belief, chickens can fly, albeit clumsily and infrequently).

A fully enclosed chicken coop built of sturdier materials — plywood or bamboo — is also necessary. Interior nesting boxes should be about one square big foot — just large enough for one chicken. For cleanliness and insulation, a thick layer of straw or hay should be scattered over all the surfaces and changed every couple of months. The old, excrement-laden material can then be composted immediately.

The other main consideration for urban chickens is protection from predators.

"We never saw raccoons in our garden until they discovered we had chickens," says Walter, a San Francisco chicken farmer. "But when they did, we saw them in there every night for three weeks." The unwelcome visitors’ persistence finally paid off when the coop was left unlocked, and the coons made off with one of two hens.

Brian W., who raised chickens for 10 years in the Bayview District, also cites hawks as a major threat to chickens living in uncovered runs, and says that rats are attracted to unclean or unsupervised coops.

"You have to think hard about how you’re going to shelter your chickens from predators," agrees Paul Glowaski, who teaches workshops on raising urban poultry at SF’s Garden for the Environment. "You might need to get creative with your space."

These considerations aside, city-dwelling chicken farmers remain overwhelmingly positive about their experiences. Inexpensive to feed (kitchen scraps, garden snails, and cracked corn play the biggest dietary roles) and content, for the most part, with entertaining themselves, backyard birds provide a gentle gateway experience for novices to animal husbandry. They offer benefits to the ecology of their environment, and help restore a connection to the food production chain. Chickens are the missing link to perfecting what Novella Carpenter of Oakland calls "the 100-yard diet." Even as a hobby, raising chickens can impart an irresistible element of eco-chic to their respective owners.

"At the end of the day, you get to be the ‘guy with chickens in his backyard,’ " Walter says. "And that can be a lot of fun."

Chop from the top

OPINION San Francisco officials released two very different documents last week. The first was a list of the 596 city employees making $150,000 a year or more in base salary. The second was a letter to the 334 patients of the Chronic Care Public Health Nursing program informing them that as of April 15 they will no longer have a public-health nurse helping them manage their illnesses.

You might expect that when the mayor proposes an "across the board" budget cut from city departments because of a looming budget deficit, almost any position in city government would be on the table. You might expect that maintaining services to the most vulnerable city residents would be a priority. But according to these two documents, you’re safe if your salary is $150,000 or more, and you are abandoned if you are poor, frail, and chronically ill.

Last week, Board of Supervisors President Aaron Peskin suggested that instead of just cutting from the bottom, the city also consider cuts at the top. "So let me understand," the Chronicle quotes District Attorney Kamala Harris (No. 55 on the top-earners list), "Aaron Peskin is basically saying we should eliminate all the doctors and lawyers who work for the city."

But Harris didn’t understand. Peskin isn’t proposing to cut all of those 596 positions. He is proposing that in a fiscal crisis, the agenda should include some cutting from the top, not just the bottom.

As a public health nurse in the program slated for closure, I’ve been working to treat and make plans for my patients during the day, while working at night to keep the program open. I’m not worried about my job: nurses are in high demand and there’s comparable pay in many private hospitals. But private health care rarely serves the people I’ve come to know doing this job for the past year: frail, uninsured elderly folks with no families; patients who face language and literacy barriers who can’t navigate the system and use emergency rooms when they feel sick; long-time residents of Laguna Honda Hospital coming back to the community not knowing how to use a cell phone, let alone monitor their diabetes.

As the number of chronically ill people skyrockets, along with the costs of caring for them, it would seem a no-brainer to fund a group of nurses who are experts in keeping those folks out of the hospital. But our health care system still operates on an acute-care model. While Medi-Cal will pay the city much of the expense of sending a nurse to do brief wound care for a diabetic, it pays much less for a nurse to keep that same person healthy enough to avoid the next wound. Calcuutf8g future savings from chronic care health services is hard. So on paper at least, it’s a money-saver, if not the moral choice, to close the program.

When I was in nursing school, my public health professors told me, "in Public Health, you have to be an advocate, because your patients can’t be." But I bet those 596 top earners can defend themselves — and Peskin is right, some of them should be given the opportunity.

Sharing the pain

EDITORIAL We’re generally not for cutting employee salaries to address the city’s budget deficit. And we’ve never been fond of claiming that doctors and lawyers who earn less-than-market wages working for the city of San Francisco should be penalized because they earn what appear in newspaper stories to be fat paychecks.

But Sup. Aaron Peskin was not on the wrong track when he suggested, only slightly facetiously, that Mayor Gavin Newsom ought to be looking for high-paid staffers to cut instead of slicing services for the poor. Peskin’s point was not so much that the top layers of city bureaucracy were outrageously overpaid (although a few of the mayor’s aides and some of the department heads he’s hired could fit in that category) but that all of the cuts have come at the bottom. Find 10 surplus bureaucrats making $150,000 a year and you could save the entire program that provides public-health nurse visits for chronically ill San Franciscans.

Sure, some of this is politics: Newsom is taking a stab at the mayor with a suggestion bound to win popular support. But it’s also a serious policy issue: when the city’s in the red, where should the burden fall? In Newsom’s current budget proposals, it falls almost entirely in the wrong places.

Eliminating a deficit of more than $300 million is daunting. Of course, the city wouldn’t have this problem if Newsom and his predecessors had been willing to look at obvious (and flexible) sources of new revenue. Public power alone would’ve brought in almost enough to cover this year’s shortfall (and would have earned the city so much cash during the better years that it could have been set aside in a rainy-day fund to prevent these kinds of budget roller-coasters). The city’s major taxes are a regressive mess; fixing the business tax alone (and making it more progressive) would help the economy and allow the city to raise cash from those most able to pay.

In other words, instead of axing nurses who help sick and housebound senior citizens, Newsom ought to be looking for money from the wealthy.

But right now, the mayor is talking only cuts — and for the most part, only cuts of lower-paid, front-line workers. The least the mayor could do is make a good-faith effort to share the pain. Looking for 10 useless high-paid execs in order to save public health nursing? How about former Sup. Bill Maher, who earns $144,838 out at the airport, where the last time we checked (see Here’s Bill; 5/26/06) he hardly ever showed up for work? Nine more patronage cronies, Mr. Mayor, and you’ll make the nut.

Bye-bye, Buster’s

Despite the clear need for a 24-hour drop-in center for homeless people to get off the streets and out of the elements, Buster’s Place was still put on the bloody budget block and closed its doors yesterday at 5 p.m.

For weeks, staff at Buster’s have been counseling the 150 to 200 people they see everyday on different places to go. 150 Otis is the city’s stated stand-in for Buster’s, run at half the cost and only open to half the population – the male half. Women are being told to go to Oshun, but resources at that 24-hour drop-in are already stretched thin.

Jennifer Friedenbach, executive director of the Coalition on Homelessness, was on the scene last night. She reports: “At least 20 people were filed out the door. Four of them were in wheelchairs. Many were elderly. Not one that I talked to had anywhere to go. There was no one from the city, not one person – not the homeless czar, not the Homeless Outreach Team, not the Department of Public Health – to assist them. Many filed over to 150 Otis to try their chances at a bed for the night in the CHANGES system, but the shelter had not opened yet.

“One woman I talked to was in a wheelchair and looked to be in her early 90’s. She was rolling slowly away, and said she had somewhere to go. When I asked her where, she clearly had no idea and was very confused. She had nowhere to go, and I did not see her in line at 150 Otis, where being female, they would not have given her a number to hold her place in line anyway.”

The sign on the door speaks the truth to the 200 people who pass through it everyday: "Buster’s Place/13th Street Drop-In will be permanently closing Monday March 31 at 5 p.m."

Will, a trim, soft-spoken man seated inside Buster’s on a Monday afternoon, reading a paper and waiting for his laundry to finish spinning, says that starting April 1, "The street is going to be where I go. The Safeway sink is going to be my shower."

Buster’s Place, a homeless services facility run by Haight Ashbury Free Clinics, is on Mayor Gavin Newsom’s midyear budget chopping block. But recently passed legislation says the city must provide a 24-hour drop-in center accessible to anyone. On March 18, the Board of Supervisors, by a vote of 9-2, passed "standards of care" mandating that all city-funded homeless shelters meet a basic level of sanitation and service, stocking facilities with toilet paper, soap, and nutritious food, as well as keeping at least one open 24 hours a day for anyone to walk in the door. (See "Setting Standards," 1/30/08 and "Shelter Shuffle," 2/13/08.)

Newsom tacitly supported the new law, but took issue with the $160,000 price tag — which does not include the $1 million it takes to run Buster’s for a year.

The Human Services Agency plans to temporarily fill Buster’s void with 150 Otis, a city-owned building across the street where storage and shelter reservations are provided for homeless people. In the past, it’s been an emergency shelter for men, but it is only permitted to operate nine months out of the year. On April 1 it will reopen with about 30 beds and 30 to 40 chairs — all for men — and will only be open until June 30, the end of the fiscal year. HSA did not respond before press time to multiple requests for more details on the plan.

Beyond trying to fix a permanent problem with a temporary solution, 150 Otis will be a shadow of Buster’s.

"Buster’s definitely handles more than 30 to 40 people a night," said the Department of Public Health’s David Nakanishi. On March 20, for example, Buster’s staff reported to Nakanishi that 98 people were on-site at 3 a.m. — 90 males and eight females. They also reported 30 people at 3 p.m. and 80 at 8 p.m.; 90 was the average between midnight and 7 a.m. Overall, the staff sees 150-200 people a day.

The drop-in center is often the first place a newly homeless person goes for help. But now those people — especially women — will have one less option.

Buster’s manager, Carolyn Akbar, has been telling clients to go to the Free Clinics’ Oshun Center, which has 24-hour drop-in services for women. But, she said, "A lot of women don’t like to go there because it’s right in the heart of the Tenderloin."

Funding for 150 Otis is coming from an HSA budget surplus. "They’re not saving any money. They said as much at the budget hearing," said Sup. Chris Daly.

Already, other city-funded facilities are feeling the strain of one less helping hand. The Mission Neighborhood Resource Center has many of the same services as Buster’s, but is only open weekdays and already operating at capacity. Still, "I’m seeing my numbers spike up," said director Laura Guzman. Contracted to serve 100 people a day, her staff tries to keep the number under 200, but lately it’s been closer to 250. "We had an incidence of violence last week as a result of more people in the facility," Guzman said. Guzman called drop-in facilities "critical players in our system of care. "When everything else fails, the drop-in is there."

Necessities like showers, laundry, restrooms, telephones, and access to medical and dental services can be found at Buster’s. Also, unlike any of the 15 other city-funded places for homeless people, it’s open 24 hours a day, seven days a week, and is "low threshold," meaning there are no basic requirements to come in.

Nakanishi listed several reasons why a drop-in center aids in overall public health, from preventing deaths on the street to providing a place to take a shower and use the bathroom. A Request for Proposals put out by DPH to continue the 24-hour drop-in services next year is also on hold, shaving a slim million from the city’s budget.

Tenderloin Health, which operates a drop-in center on Golden Gate Avenue, was one of the respondents to DPH’s RFP for a 24-hour center and said it was more than willing to extend operating hours past the current 11:30 p.m. closing time.

"The funding was pulled the same day we submitted the proposal," said Colm Hegarty, director of development for the nonprofit. "We would do it. Our proposal was very specific."

Drop-in centers have been criticized as places where people hang out and avoid the shelter systems and services they provide, but that was never the intention for Buster’s, which has only been open for 13 months. "The program was designed to really have around the clock case management," said Nakanishi, who wrote the RFP.

Akbar said Homeless Outreach Team officers were supposed to be working with center staff to move people deeper into the care system, but she’s been told they’re too busy working with people on the streets.

Which is what Buster’s is all about. Most of the people still on the streets aren’t interested in doing something to change their situations, points out Keith Bussey, deputy director of integrated health services for the Haight Ashbury Free Clinics. "But people who come into a drop-in are in that pre-contemplative stage of change. They’re venturing inside for maybe the first time."

Will is unequivocal about Buster’s proposed replacement: "Not 150 Otis. I don’t want anything to do with 150 Otis because of the people who work there." Claiming he’s received rude treatment there too many times, Will even stopped using the storage facility there. Middle-aged and homeless in San Francisco for the past couple of months, he sleeps outside and after two stays in the city’s shelters said, "Never again."

"Ultimately it’s going to hurt the city," said Hegarty of the closing. "You’ll see more of a presence on the streets. People will want to see something done about it, so there will be more police responding. The criminal justice system is going to become burdened. The emergency room at San Francisco General is going to become burdened. People will go anywhere they can just to get off the streets."
