Reagan youth regurgitated

REVIEW Tired of those battered punk-rock veterans of the hardcore years? You know, the geezers rocking in their thrift-store easy chairs, wheezing, “You had to be there — those were the days. I saw Darby when …” before heading to the acupuncturist? Can you help it that you never saw Flag back before My War? That you never tasted the ostracism that the real punks experienced?
No — and those born too late, after the jocks took over the mosh pit, will be thankful that none of the aforementioned ’tude is present in this exhaustive but not exhausting documentary by Paul Rachman and Steven Blush. The filmmakers’ cred is impeccable (Rachman directed music videos for Bad Brains, and Blush wrote Feral House tome American Hardcore: A Tribal History, upon which the film is based), and their resilience (the two toiled in true DIY style for five years on this sprawling document) allows them to rise above Johnny-slams-lately poseur status. And as historians, journalists, and cat wranglers, they deserve the highest praise meted out to those hoping to encapsulate a fired-up, barely containable, and truly grassroots DIY movement: they get the story mostly right.
The filmmakers conducted more than 100 interviews with key players in the US hardcore scene (as well as sundry head-scratchers like, um, visual artist Matthew Barney). My, does it show. Getting essential punkers like Minor Threat’s Ian MacKaye, Bad Brains’ HR, Circle Jerks’ Keith Morris, Cro-Mags’ Harley Flanagan, and Black Flag’s Henry Rollins to party with the camera and to tell their own stories was the best possible move the filmmakers could have made. Their subjects look back with all the intelligence, humor, honesty, urgency, and perhaps surprising to some, subtlety that made them form their own bands, book their own tours, and put out their own music in the first place.
Within the first half hour, Rachman and Blush do the important work of politically contextualizing the 1980–86 wave of hardcore, connecting the dots between the “mourning in America” election of Ronald Reagan; an era that only appeared to offer the alternate balms of disco decadence and shallow sitcom kicks; and the rise of a disgusted and less-than-heard generation that produced more songs, posters, and agitprop railing against a sitting president than the world has seen … until Dubya. Few other recent music docs have been as refreshingly clear-cut — and cutting — about their politics, a direct reaction to an ’80s marked, as one commentator puts it, by a ’50s-style return of the “white man’s order.” In a sense, American Hardcore will be an education not only for kids bred on MTV-appropriated mall punk but for baby boomers convinced of Generation X’s apathy; a far-from-mellowed Vic Bondi (Articles of Faith) offers, “If you’re looking for radicalism in the 1980s, you should look at hardcore.” The film also gives adequate shrift to the pressures that shaped and perhaps ultimately destroyed the genre — for instance, the TV news–making melees between punks and the Los Angeles Police Department — drawing the line from those clashes and band names like, natch, Millions of Dead Cops (MDC).
Bristling with the energy of its music, fans, and grainy shots of men yelling into mics at rec centers, Kiwanis clubs, and random bunkers-turned-venues throughout the country, American Hardcore abounds with great moments. Rachman and Blush rightfully focus on the nexus between DC and LA — Minor Threat–Bad Brains and Black Flag–Circle Jerks — giving Bad Brains in particular, and notably the few black faces in a wash of pasties, their genuine due and eyeballing that straight-outta-an-unwritten-great-American-novel, Apollonian-Dionysian odd couple, MacKaye and Rollins. Though one wishes the filmmakers had snagged more and better live footage, American Hardcore can still claim such incredible, illustrative instances as that of the graying Rollins complaining today of all the crap he’d catch from audiences as Black Flag’s frontperson (remember the halcyon days when being in a punk band meant getting loogied on?) followed by archival images of Rollins onstage getting repeatedly pummeled by an audience member before the vocalist finally loses it and starts wailing back a hundredfold.
But even as the filmmakers display a real affection for their subject, they resist getting too nostalgic. Rachman and Blush don’t pull punches when it comes to fingering the sexism and violence in the scene — and go as far as to name names. Yet the filmmakers talk to too few women and apart from Bad Brains, too few players or observers of color: perhaps there’s no skewing reality, but for a scene that’s this politicized, it looks pretty pale and male.
Perhaps revealing their native predispositions and personal connections, the pair also give the Boston and NYC scenes far too much emphasis and they pointedly neglect the flyover zones. Where are Minneapolis’s Hüsker Dü and Texas’s Big Boys? And while Rachman and Blush get brownie points for their cultural-anthropological leanings and quirky side stories, they eventually fall down on exploring the music itself, its permutations, and its impact outside the rec rooms: do we get any inkling, for instance, of the fact that hardcore started to seep into the MTV mainstream with bands like Suicidal Tendencies?
When the scene finally peters to a close in ’86, Rachman and Blush chalk it up to fickle fans moving on with the trends — wither hair bands? — and stalwarts like MacKaye wearying of the fisticuffs, but there’s just as valid a case to be made for the music changing and artists evolving, as they so often inconveniently do. Black Flag morphed toward heavier, sludgier metal, Bad Brains embraced tradder Rasta sounds, and MacKaye broke it down, post-punk-style, with Fugazi. But perhaps that’s for the next installment: American Hardcore: the Metal/Grunge Years. SFBG

Same-sex marriage: On to the Supreme Court

EDITORIAL It’s hard to take the California Courts of Appeal decision on same-sex marriage seriously. It reads like some sort of joke, the product of a bad old mind-set that this country put behind it almost 40 years ago when the US Supreme Court struck down bans on interracial marriage. It’s worse though: the court, by a 2–1 decision, seems to imply that gay and lesbian people don’t have the same fundamental legal rights as everyone else, that discrimination against them doesn’t need to be viewed with strict legal scrutiny.
Hiding behind the absurd notion that the court would be usurping the role of the legislature by finding that it’s unconstitutional to outlaw same-sex marriage, Justices William R. McGuiness and Joanne C. Parrilli overturned a landmark ruling by San Francisco Superior Court Judge Richard Kramer and set the stage for what has to be a full debate before the state Supreme Court.
On many, many levels, this is the defining civil rights issue of our era — and the state’s highest court must agree to take the case and overturn this embarrassingly misguided decision.
The court goes out of its way to try to sound sympathetic to gay and lesbian couples, acknowledging in its ruling that social standards are changing and that “gay and lesbian couples can — and do — form committed, lasting relationships that compare favorably with any traditional marriage.” But the two judges in the majority argue that the state legislature hasn’t legalized same-sex marriage, so there’s nothing the courts can do.
That, of course, is nonsense and flies in the face of centuries of American legal jurisprudence (and most recently, of the well-reasoned decision by Judge Kramer). The Virginia legislature had explicitly refused to legalize marriage between people of different races when the Loving case came before the US Supreme Court in 1967; the court ruled, quite properly, that the so-called antimiscegenation laws by their very nature deprived people of a fundamental constitutional right. The right to an abortion was never established by Congress; the Supreme Court ruled in 1973 that the constitutional right to privacy protected the right of a woman to terminate her pregnancy. The list goes on and on: when courts find that state and federal legislators have acted in a way that undermines basic legal rights, they often wind up enshrining in law rules that were never put to a majority vote.
Besides, let’s remember: the state legislature did take up this issue and passed a bill — which the governor vetoed, saying he was leaving the issue to the courts.
Justice J. Anthony Kline, the lone dissenting voice, put it very nicely: “To say that the inalienable right to marry the person of one’s choice is not a fundamental constitutional right, and may therefore be restricted by the state without a showing of compelling need, is a terrible backward step…. Ignoring the qualities attached to marriage by the Supreme Court, and defining it instead by who it excludes, demeans the institution of marriage and diminishes the humanity of the gay men and lesbians who wish to marry a loved one of their choice.”
San Francisco City Attorney Dennis Herrera will, of course, appeal this decision to the state Supreme Court, where everyone has assumed it was heading anyway. But there’s a danger here: the high court could duck the entire issue, more or less, by simply declining to hear the case and letting the appeals court decision stand. That would be a tragedy. Everyone involved on all sides agrees that this is a huge issue, both legally and politically, and two appellate judges on a sharply divided three-judge panel simply can’t be allowed to hold the last word.
We urge the Supreme Court to take the case. So should every Democratic (and decent-minded Republican) politician running for office this fall, starting with Jerry Brown, the leading candidate for attorney general.
The ultimate outcome of the debate over same-sex marriage isn’t in doubt. A few years from now — 5, 10, 15, 20 — the bigots will have lost their hold on politics and same-sex marriage will be as widely accepted as interracial marriage is today. California can either be a national leader in this progressive cause — or suffer the shame and embarrassment of being a state where the highest court enshrined unconscionable and indefensible discrimination into its constitution. Buried treasure

Despite the fast-moving urban centers that surround it on each side of the San Francisco Bay, not much about Treasure Island has changed since it was shut down as a United States naval station 10 years ago.
After the feds ceased operations on the island and at several other military installations in the mid-’90s, the idea was to give the land to local governments for redevelopment to fill the economic void of losing active bases. Since then, several plans for Treasure Island have been floated with great fanfare in the press, but all have become mired in the infamously contentious development politics of San Francisco.
Late last month, after three years of deadline extensions, the Treasure Island Development Authority (TIDA) finally received a full-blown plan from the developer — a partnership between Lennar Corp., Wilson Meany Sullivan, and Treasure Island Community Development — that was given exclusive negotiating rights over the land three years ago.
The $1.2 billion redevelopment plan must now run a gauntlet of state and local approval, including consideration from the Board of Supervisors, which is expected to hold hearings and debate the plan by the end of the year. It isn’t likely that construction will begin on the island for at least a couple more years.
The latest proposal anticipates about 6,000 new homes, 1,800 of which will be targeted to low-income residents, including 750 units for households earning no more than 60 percent of San Francisco’s median income and 440 built as part of a program for the homeless. Plans include town houses, single-family homes, and high-rise residential towers, although at least half the properties will be limited to 65 feet in height.
Right now the island contains about 800 occupied units, over half of which are market-rate leases with the John Stewart Co., while about 200 are operated under the Treasure Island Homeless Development Initiative. By the time the project is done, according to the newest plan, the island’s population is expected to balloon to around 10,000 residents, plus around 3,000 new workers necessary to maintain the minicity.
Some of the existing housing stock will be demolished, or as the plan calls it, “reconstructed.” Current residents will have an option to move into the new units or be placed in a lottery if demand for certain types of units outstrips the supply. The plan calls for about 27 percent of the overall planned housing units to be rentals.
Private automobile use would be regulated by metering ramp access to the island during peak commute hours; assessing possible congestion fees for driving on the island; limiting residential parking; and emphasizing thruways that promote walking, bicycling, and public transit.
Much of the development is slated for the west side of the island — with its breathtaking and profitable views of the city — near an existing ferry terminal that would provide access to the city all day long.
Treading lightly, Sup. Chris Daly, whose District 6 includes the island, said he supports the environmental and housing components so far, but if existing island residents mount significant opposition for any reason, he’d consider opposing the plan.
“You don’t know how clean something is until you take it out of the wash, and they’re just now starting to throw it in,” Daly told the Guardian.
Rob Black, Daly’s main challenger in the upcoming election, lives on Treasure Island. He was similarly cautious. “I think people have finally begun to think in a more progressive way about making this a more sustainable neighborhood,” Black told us. “Past plans have been so poorly put together.”
On the local level, the plan must be approved in the coming months by both the TIDA board and the Board of Supervisors. After that, it will undergo an extensive environmental impact review by the city’s planning department before returning to the board for final local approval.
The developer and the TIDA board — which is composed entirely of mayoral appointees, three of whom work directly for Mayor Gavin Newsom — must still overcome other major hurdles as well, including the fact that the Navy hasn’t turned over any of the land yet and likely won’t without major concessions.
The Bush administration has stalled the transfer, pushing for some payment before giving up valuable federal land. One tentative option is to relieve the Navy of about $45 million in environmental cleanup costs for which it is currently responsible. Those costs would then be borne by the redevelopment plan and the developer, which has already pledged $26 million for remediation. The land became contaminated in part after decades of military activity that included emergency drills with radioactive materials.
David Rist, a project manager for the state Department of Toxic Substances Control, which is overseeing the cleanup, said that while there is some contamination where residents are living today, it doesn’t pose an immediate threat to human health. Identified contaminants include dioxin, lead, and PCBs. Rist told us the cleanup, regardless of who ends up paying for it, will be “significantly done in the next two and a half years.”
After mulling over ideas, TIDA finally brokered an exclusive deal in 2003 with a company incorporated as Treasure Island Community Development, a group of Democratic Party heavyweights with deep links to the current and former mayoral administrations and other top elected Democrats.
Jay Wallace, a project planner for Treasure Island Community Development, said the plan’s mammoth size and uniqueness have required considerable and time-consuming attention to specifics. Investors anticipate spending $500 million of their own money, but they’re looking to earn upward of $125 million in profits, according to the plan.
The remaining cost of about $760 million for infrastructure, open space, and transportation system improvements could be covered largely by tax increment financing from the redevelopment area and Mello Roos bonds, both of which would essentially be funded by future property taxes, according to the latest term sheet.
Wallace told the Guardian that his group “has worked in good faith and transparency throughout this project, with over 150 public meetings before reaching this milestone and presenting this plan to the city.”
Daly said that while “there are going to be a hundred issues that need to be worked out,” the green-meets-affordable-housing theme “is the right proposal for San Francisco.”
“Political connections to the Newsom juggernaut notwithstanding, these guys are politically savvy enough to know what’s wise and what isn’t,” he said. “On the actual merits of the proposal, it’s palatable if you’re OK with the concept of high-rises in the middle of the bay.” SFBG

If there’s one person you would expect to condemn the present state of America’s political affairs, it would be Billy Bragg, right? Surely Britain’s punk poet laureate should be grabbing every microphone within reaching distance to decry the evils of our current administration. But surprisingly, his reaction is quite the opposite. “I’m encouraged by the results of the last two elections, because I believe that America has not yet decided what kind of country it’s going to be in the 21st century,” he says on the phone from Winnepeg.
Bragg is currently on a bit of a multitasking tour to showcase his two latest works: Volume II (YepRoc), a box set, and The Progressive Patriot, a book. While Volume II is an expected retrospective that covers the second half of Bragg’s career from 1988 onward, The Progressive Patriot is uncharted territory for the singer-songwriter, a treatise that addresses Britain’s national identity, the emergence of organized racism, and the political road that weaves between the two.
Much as in Britain, Bragg sees battles of ideology as a key proving ground in the future of our country and agrees with the concept of “two Americas” as it pertains to the states’ political climate. “On one hand you’ve got the neoconservative Christian right, who are getting everybody to vote and still can’t get a majority,” he says, “and on the other side you’ve got the more compassionate idea of America as a multicultural society, which just can’t get everybody to vote.” Yet as bleak and insurmountable a problem as this may seem, Bragg takes the long view. “I’m in a fortunate position. I have the opportunity to travel around and meet people trying to manifest that ‘other’ America. Reading local newspapers in America, you see all sorts of things that are going completely against the neoconservative agenda in some states.” Volume II picks up at a crucial period of Bragg’s career, kicking off with his 1988 release, Workers Playtime (Go! Discs/Elektra). The album marked Bragg’s transition from punk iconoclast to, as he would later affectionately come to be known, the “Bard from Barking.” Instead of using just his guitar and a portable amp as on his earlier recordings, Bragg included bits of orchestration on Workers, plus a band to accompany his songs of law, love, and everything in between. “The album of lost love. It’s my great lost soul album!” he says with a wistful chuckle.
At the heart of that bittersweet collection is the amazing “Valentine’s Day Is Over,” a woman’s lament over her lover, rough economic times, and the beatings that result. “That economy and brutality are related / Now I understand,” the protagonist explains wearily. Bragg feels a particular satisfaction with that song and the topics it tackles. “I often cite that as the ideal Billy Bragg song because politics and ‘the love song’ overlap in that song. It’s a really hard thing to do, rather than being a ‘love song writer’ or a ‘political song writer.’ I hate it when people divide those two. Life isn’t divided like that.”
The ever-encircled worlds of life and politics also led Bragg to write the new book, with the ideas spurred by everything from recent elections in his hometown to raising his young son. “A far-right political party called the BNP earned a seat on the council in my hometown of Barking, East London,” the songwriter says. “That was a real shock to me because these were the people that I came into politics fighting. I realized that it needed something more than just writing a song.” Being a father further drives his desire for intelligent debate around the future of his country. His concerns about nationalism are expressed in the interest of cohesion, not the racist ideal of exclusion. He explains, “I’m interested to hear your background, but what is important to me is how my children and your children are going to get on with each other. Everything else is secondary to that.”
As you might expect, Bragg’s MySpace page also bears the mark of his beliefs and ideas. It also contains his songs: items that were conspicuously absent during his recent showdown with the networking Web site. Having successfully lobbied MySpace to retool their artist agreement so that the site doesn’t “own” any artist’s uploaded content, Bragg is now taking on MTV Flux, another networking site that features an upload ability similar to YouTube. A video featuring his challenge to Flux dots the page, along with archival footage of him at various events, such as a concert in Washington, DC, in 2002. That day he addressed the crowd and warned them of a greater looming evil — not of conservatives or imperialism but of cynicism.
He still stands behind that message. “I know from personal experience that cynicism eats away your soul,” Bragg says. “God knows Tony Blair’s been spreading cynicism around for the last few years. I’ve had to fight my own.” SFBG

Really scary

I had a really scary moment tonight.

it started well — I was moderating a discussion on immigration politics at New College, featuring Justin Akers Chacon, who has written a new book called “Nobody is Illegal.” Renee Saucedo, a longtime advocate for immigrants and day laborers, was on the panel, too, and we had a great discussion — until the very end, when Saucedo starting talking about how she was trying to build coalitions between immigrants and African Americans in Bayview Hunters Point, organizing around opposition in that neighborhood the the redevelopment plan.

And out of nowhere, she urged everyone to vote yes on Proposition 90.

For the record, Prop. 90 is almost indescribably horrible. It’s a radical right wing property-rights measure that would instantly halt any new environmental laws, any new rent-control laws, any new workplace safety laws, any new zoning laws, any limits on evictions or condo coversions … it would effectively stop government regulation of private property in California.

So why was Saucedo, a smart lawyer and strong progressive, supporting it? Because Willie Ratcliff, the publisher of the San Francisco Bay View, and Marie Harrison, a candidate for supervisor from District 10, are so dead-set against redevevelopment that they’ve signed on with the worst of the right-wing nuts in the state to endorse a measure that claims to be limiting eminent domain but is so much, much more.

I’ve discussd this with Harrison; she totally doesn’t get it. Neither, for now, does Renee Saucedo. I understand their fear of redevelopment seizing people’s homes — and I understand Saucedo’s desire to build ties with and follow the lead of African American community leaders. But get a clue, my friends. This is embarassing.

If people like Renee Saucedo are getting duped into supporting the worst law to come along in California since Prop. 13, we’re in serious trouble.

The final frontier

Ask Aron Ranen about his filmmaking philosophy, and he won’t pause long. “I’m a reality surfer. Things pop up as I’m quote-unquote traveling around the world with my camera.”
When he says “pop up,” he ain’t kidding. While attempting to uncover the truth about the Apollo 11 moon landing in Did We Go? (which screened in 2000 at New York’s Museum of Modern Art), Ranen stumbled upon the fact that the magnetic tapes used to record the 1969 event had gone missing. This peculiar nugget resurfaced in the news lately, generating enough buzz beyond the conspiracy fringes to nudge NASA into a response via its Web site: “Despite the challenges of the search, NASA does not consider the tapes to be lost.”
A month ago Ranen appeared on CNN to discuss the controversy. Host Glenn Beck tried awfully hard to paint the doc maker as a wackjob; the segment ends with a joke likening those who believe the moon landing was faked to those who are “still wondering why Darrin One was mysteriously replaced by Darrin Two.” This kind of reaction doesn’t seem to bother Ranen, who between movies teaches digital filmmaking at DV Workshops, the school he runs out of his Mission District studio.
“My motto is film the obvious,” he explains. (Later in our conversation he expands that motto to include “trust reality … and also don’t fuck it up.”) “I’m just trying to illuminate some of the things that are going on in our culture.” Did We Go? is actually not a wackjob’s manifesto; it features interviews with Apollo 11 flight director Gene Krantz and astronaut Buzz Aldrin — as well as the NASA employee who physically closed the hatch on the rocket before its launch. The film doesn’t try to discredit the moon landing; it tries, with sincerity, to prove that it actually happened. (In other words, there’s a reason it’s not titled We Didn’t Go.)
A filmmaker since he was 13, Ranen has made so many short documentaries that he’s lost count. Over the years the self-funded artist has developed his own approach to shooting. His films are generally unstructured — expecting the unexpected — and are guided by Ranen’s first-person voice-overs, delivered in a tone that hovers between curiosity and amazement.
“Everyone trusts me and talks to me in my films,” he says. It’s a claim backed up by the openness displayed by his diverse array of subjects, many of whom Ranen meets on the fly. His film Power and Control: LSD in the 60s — a tangent-riddled exploration of the drug’s influence on politics and counterculture — features chats with an ex–Stanford University researcher whose simian LSD tests earned him the nickname “Monkey Mike” and a now-elderly professor who was among the Harvard students who participated in Timothy Leary’s 1962 Good Friday experiment. Ranen attributes this kind of access to his lone gunman style.
“I refuse to let anyone go with me. I believe so much of documentary is about the relationship between the filmmaker and the subject. I don’t want a crew or a sound man to mitigate my relationships with these subjects,” he explains. “When I’m talking to someone, you can see their enthusiasm in talking to me.”
Ranen’s go-with-the-flow methodology extends to postproduction. He “edits organically,” subscribing to what he calls “the pinball effect: as you’re watching it, the edit speaks to you and says, no, take that stuff in the middle and put it up front.” He’s also not opposed to altering his films after they are finished. Power and Control screened as a 70-minute feature at the 2005 San Francisco Independent Film Festival; the version at Other Cinema this weekend hovers closer to 40 minutes. Eventually, Ranen hopes to add a chapter exploring the possible LSD-KGB connection.
His most recent film, Black Hair, is also his most widely seen, thanks to a strategy of free distribution via YouTube. The doc, which Ranen says has been viewed some 100,000 times, delves into the racial and economic issues raised by the fact that most of the black hair-care industry’s retail and wholesale markets are controlled by Korean, not African American, businesspeople.
Ranen’s film inspired Bay Area hair-product manufacturer Sam Ennon to found the Black Owned Beauty Supply Association, or BOBSA, now a national organization aimed at what Ennon calls “reorganizing the whole industry in terms of the distribution channel. It’s not that we want to run the Koreans out of business — we just want to share in the business. We want to recirculate the black dollar.”
Ennon says Black Hair gave BOBSA’s cause a major assist. “A picture speaks better than words. The film is really what turned it completely around.”
It’s all in a day’s work for Ranen, who seems to attract unexpected spontaneity and the not-occasional weird coincidence. His DV Workshops was funded with a settlement he received after learning that Nine Inch Nails had sampled one of his films without permission. The dialogue snippet, taken from Ranen’s film Religion in Suburbia, just happened to include this phrase: “do you believe in miracles?” SFBG

Fascinated disgust and aghast amusement are two feelings I don’t experience often enough. Jesus Camp elicits both in spades. This doc by Heidi Ewing and Rachel Grady (The Boys of Baraka) travels into the darkest heart of America’s evangelical Christian movement: a North Dakota summer camp that whips born-again children – most already home-schooled into such beliefs as the nonexistence of evolution and global warming – into religious frenzies. The film also places emphasis on the palpable evangelical presence in American politics – with a chilling look toward the future, when this brainwashed-from-birth generation will eagerly join the right-wing voting bloc. “Mexico as Muse: Tina Modotti and Edward Weston”

Intended as an archive for the monumental partnership between two major artistic figures, Tina Modotti and Edward Weston, the San Francisco Museum of Modern Art’s “Mexico as Muse” serves more as a teaser to Modotti’s life and work. While Weston’s images of earthen pots and Mexican skies build a foundation for later works, his portraits of his artistic partner are by far his most interesting contributions to “Mexico as Muse.” Modotti chose her subjects carefully, opting for the limitless possibilities of telephone lines stretching over the rural Mexican landscape and flimsy, partially ajar doors instead of the immobile nature of Weston’s content. Her most famous photo featured here is a bundle of white roses, clumped together in limp and fragile decay. (K. Tighe)

Hornblower Yachts assumed control of the ferry service to Alcatraz Island on Sept. 25. As the new crew cast off the dock lines, spurned union workers — some 30-year veterans with the former contractor, Blue and Gold — rallied with supporters at the entrance, asking passengers not to board the boats.
Two union-friendly visitors from Sydney, Australia, ripped up their tickets and demanded refunds. “We don’t agree with what they’re doing to the workers,” one said, while in the background Supervisors Aaron Peskin and Tom Ammiano took turns with the bullhorn, also offering their support to the workers.
“All of our colleagues on the board are not going to stand for it,” Peskin said to the couple hundred laborers gathered on the sidewalk. “We’re going to stand with you and march with you.”
Terry MacRae, CEO of Hornblower, expressed little concern about the boycotting tourists and the rally at his gate. “I suspect there’s plenty more people who want the tickets if they’re not going to use them,” he told the Guardian. Visits to Alcatraz peak this time of year, with a couple thousand people turned away every day when tickets sell out, according to National Park Service spokesperson Rich Wiedeman.
The NPS decision to grant the lucrative, 10-year contract to Hornblower over Blue and Gold has resulted in more than just what some are calling the largest union layoff in San Francisco waterfront history. The story also has an environmental angle as slick as an oil spill and a nasty landlord-tenant tussle.
“The port and I are extremely concerned with how Hornblower has conducted itself,” City Attorney Dennis Herrera told the Guardian, referring to the company’s artful dodge of city and state permitting processes. “They’ve focused more energy on sidestepping public oversight than complying with it.”
Despite infuriating two leading San Francisco institutions — unions and city planners — MacRae has managed thus far to avoid too much of a stir by keeping another critical local constituency off his back with a well-played “green” card.
THE GREEN MACHINE
When NPS put out a request for proposals in 2004, three companies submitted bids for Alcatraz: Red and White, a local charter and bay cruise company that ran the service when it first started in the ’70s; Blue and Gold, which took over Red and White’s boats and unionized crew in 1994; and Hornblower Cruises and Events, which runs charter and dinner boat cruises from five California ports and is a subsidiary of a larger, $30 million company.
When Brian O’Neill, superintendent of the Golden Gate National Recreation Area, announced last year that Hornblower won the bid, union activists immediately challenged the choice. Mayor Gavin Newsom, Peskin, Rep. Nancy Pelosi, and both of California’s US senators expressed concerns about the decision. Neighborhood group Citizens to Save the Waterfront filed suit. Environmentalists, however, were elated.
For the first time since being passed by Congress in 1998, the Concessions Management Act applied to the bid for Alcatraz. In addition to forbidding the Department of the Interior from favoring incumbent contractors, the act also outlined new criteria for awarding contracts that included a mandate to improve environmental quality in national parklands.
“Bluewater Network has been advocating for more than five years for a solar- and wind-powered ferry for San Francisco Bay,” said Teri Schore, a spokesperson for the local environmental group. She added that diesel vessels in the Bay Area account for more pollution than cars and buses combined. “We’ve been talking to every ferry operator on the bay, and we also knew that the Alcatraz contract was up. We thought it was the perfect application.”
Hornblower’s MacRae wrote a provision into his bid that within two years of taking over the Alcatraz service, the company would build and launch a ferry to run on a combination of solar, wind, and diesel power. After one year of testing the vessel, a second would be built within five years.
That — in combination with a plan to make two initial vessels 90 percent more fuel efficient, as well as implement a clean energy shuttle service on the Embarcadero, power the landing facilities with solar panels, purchase green products, and vend healthy snacks — put Hornblower’s bid over the top.
Wiedeman said all bidders are informed that financial feasibility of the company and potential revenue for the government, as well as environmental and sustainability initiatives, were considered. But some criteria were more weighted than others, and Hornblower ranked strongly on all points.
“We’re ecstatic,” Wiedeman said. “We’re looking at higher-quality visitor services from the get-go.”
But some doubt whether the proposed vessels are anywhere close to a reality. MacRae said a final design and marine contractor have not been selected yet, although Solar Sailor’s model BayTri has been touted. A giant solar-arrayed fin provides auxiliary wind and sun power to the trimaran’s diesel engines. No such vessel has ever been built, but the model is based on a smaller solar ferry that services Sydney Harbor in Australia — with a top speed of just seven knots.
The proposed boat is emissions free and could go 12 knots with the aid of the wind, although it would need a push from auxiliary diesel engines to keep up with Alcatraz’s schedule. Boats now run between 15 and 19 knots.
The other concern is that MacRae’s commitment of $5 million for constructing the 600-passenger vessel might not be enough. The San Francisco Water Transit Authority has been looking into a similar vessel carrying no more than 150 passengers that would cost between $6 and $8 million.
“Their requirements for design are different than what mine would be,” MacRae said. “I think it’s possible to do it for $5 million.”
Bluewater Network founder Russell Long worries that the low-budget cap could hurt the vessel’s environmental potential. “We believe that Hornblower may intend to maintain this budget ceiling even if it compromises other aspects of the design, such as best management practices in regard to environmental components,” he wrote in a letter to NPS, urging reconsideration of the contract.
NPS awarded the contract anyway and Bluewater is hoping for the best.
“We will be watchdogging the progress and keeping track of what’s going on. If it doesn’t happen, it will be a huge black eye for the National Park Service, Hornblower, and the city of San Francisco,” Schore said. “At this point we have faith that it’s going to get built, because it’s in the contract.”
However, Hornblower’s snub toward union contracts and dodgy relations with the city suggest that playing by the rules may not be a top priority for the company.
THE PERFECT TYPO
Since 1974, boats to Alcatraz have run from the Pier 39 area of Fisherman’s Wharf, where waiting ticket holders can indulge in the myriad distractions the tourist hub offers.
MacRae launched his new ferry service from Pier 31, half a mile farther south on the Embarcadero, where he currently leases space and operates a charter and dining cruise business.
Pier 31 is little more than a parking lot with a ramp and floating dock, which only sees about 100,000 people a year, far fewer than the 1.3 million annual passengers Alcatraz draws.
MacRae has attractive plans for a complete overhaul of the area, which would include landscaping and sheltered seating, a bookstore, and an informational center. Such alterations would require a thorough run through the city’s planning process, which MacRae told the NPS he won’t be doing until 12 to 18 months from now.
Instead, interim improvements to the lot were planned, which sparked concern from the city that the sudden increase in foot traffic wouldn’t be properly mitigated. That area of the Embarcadero also hosts 250,000 passengers a year from cruise ships docking at adjacent Pier 35. The Port spent close to $200,000 last year controlling that traffic with signage and police officers. The addition of thousands more visitors streaming down the sidewalks seeking passage to Alcatraz could cause gridlock every time a cruise ship docks.
Monique Moyer, executive director of the port, sent repeated letters over the last year to MacRae asking for clarifications about his plans and expressing concern that the change in use of Pier 31 required a review of existing permits.
She wasn’t alone. On July 31, Citizens to Save the Waterfront filed suit against Hornblower, claiming that the amount of activity at Pier 31 would increase twentyfold. “That represents a substantial change in the intensity of use,” Jon Golinger, a representative from the group, told us.
A change in the intensity of use of a waterfront property triggers the need for a complete environmental impact review (EIR) from the Bay Conservation and Development Commission (BCDC), a state agency with jurisdiction over anything within 100 feet of the shoreline. As many city developers know, EIRs can take many months to consider all potential changes to the existing landscape that the applicant would cause. Delays of that sort could have hindered MacRae’s ability to assume ferry service on the contracted date of Sept. 25.
MacRae said the litigation kept him from divulging to the city his proposed plans for upgrades to the pier.
Just days before the lawsuit was to be argued in San Francisco Superior Court on Sept. 6, BCDC executive director Will Travis sent a letter to Moyer stating that Hornblower’s new service and alterations to Pier 31 did not require any new permits.
He cited a typo from Hornblower’s current BCDC-issued permit as an allowance for the increase in passengers. The permit states that the pier may provide “access to the entire bay via vessel for 200,000 to 5000,000 [sic] people/year.”
He footnoted the quote: “There is clearly a typographical error in the 5000,000 number, which is intended to state the maximum anticipated usage of the dock … the correct number is probably either 500,000 or 5,000,000. While it seems reasonable to believe that the correct number is 500,000, the record contains nothing to substantiate this conclusion.”
Travis also relayed that Hornblower plans to use temporary measures that include trailers with port-a-potties, a portable ticket booth, and hollow traffic barriers for guiding traffic and pedestrians on and off the boat.
Herrera told us that this was the first Moyer had heard of what was planned for the lot and there was concern about how other services in the area and traffic on the Embarcadero would be affected, as well as if any structures, signage, and other enhancements would require additional permits. “It certainly would have been nice if they had shared all these plans so the port could conduct the proper environmental review that we all agree is in order,” he said.
In a strongly worded letter to Travis, Herrera wrote that to allow Hornblower to proceed without any environmental review could violate the California Environmental Quality Act (CEQA) and urged the BCDC to “issue an immediate cease and desist order” to prevent the start of service. Herrera also made the salient point that “the later the environmental review process begins, the more bureaucratic and financial momentum there is behind a proposed project, thus providing a strong incentive to ignore environmental concerns that could be dealt with more easily at an early stage of the project.”
On Sept. 7, BCDC commissioners met in closed session at the end of a four-hour meeting and voted to stand by Travis’s argument.
David Owen, a former Peskin aide who’s also a BCDC commissioner, was one of two abstentions to the otherwise unanimous vote. “It was really frustrating, because it seemed like Hornblower did everything in their power to avoid a permit review,” Owen told us. “Now what? We have a CEQA lawsuit and then the Board of Supervisors shuts down the Alcatraz ferry service? They’ve managed to start up service without acquiring a single permit. Kudos to them for strategy.”
Citizens to Save the Waterfront then dropped its lawsuit, feeling it was weakened by the BCDC decision.
“Essentially, now there’s a turf war between Bush’s park service and the Port of San Francisco,” Golinger said. “BCDC tried to avoid getting involved, but the precedent it sets is horrible. A corporation can come in and skirt any planning process.”
UNION TOWN POLITICS
After scoring the Alcatraz bid, Hornblower sought an exemption to the Service Contract Act of 1965 that would have required MacRae to pay equal to or more than what current crew make. But the Department of Labor ruled Sept. 21 against Hornblower. So veteran Blue and Gold crew have added safety to their concerns.
“I’ve made tens of thousands of landings on Alcatraz Island, and now they have captains who have never been there,” Capt. Andy Miller said. For 17 years, Miller has navigated the busy shipping lanes and the constant summer fog against the tugging tide and the sudden slams of inclement weather to bring tourists, park service staff, and supplies to the island.
“No one’s ever gotten hurt. It’s a very tricky place to land a boat. It takes skill and experience that you can’t just hire off the street,” he said.
Miller said he applied for a job with Hornblower but was not interviewed. So far, no captains and only three ticket agents and a deckhand have been hired from Blue and Gold’s former fleet.
“We have a ready workforce,” Master, Mate, and Pilot union spokesperson Veronica Sanchez said. “They’re going to have to be paid the same wages as union workers at Blue and Gold. They don’t want to be a union shop. Why don’t you want to be a union shop on a union waterfront like San Francisco?”
One reason could be concern that it might bump up costs for Hornblower’s other tour operations. “They want us to agree that if we sign up our workers for Alcatraz, that we won’t organize the dining yachts,” Sanchez said. In 1998, the union attempted to organize Hornblower’s dinner cruise operations in San Francisco but didn’t prevail in a supervised election.
MacRae said he’s not opposed to the unions and he’s encouraged the Blue and Gold staff to apply for jobs. “The unionization is the choice of the workers,” he said. “We try to let the employees make the choices. Last time I checked, that’s who the unions represent.”
“We want to make sure we have the best crew,” he said. “Many of the products and guest services we provide aren’t what Blue and Gold do now.” He added that some current employees from the dining cruises have also been shifted to the Alcatraz route.
“I’ve been here 21 years, and we’ve been replaced by busboys and waiters,” said deckhand Robert Estrada, standing with fellow workers outside the gate of the new Alcatraz ferry service.
Estrada said Hornblower’s reliance on part-time, low-wage workers has earned the company the nickname “the Wal-Mart of the Water.” The company’s rapid expansion, from a two-boat Berkeley-based charter to a multinational fleet with government contracts is a similar characteristic.
Blue and Gold spokesperson Alicia Vargas assured us that the remaining ferry services to Alameda, Angel Island, Oakland, Sausalito, Tiburon, and Vallejo will be solvent, but some of the veteran crew who haven’t been laid off yet are worried this is the beginning of the end.
“The public needs to be warned. If funds don’t come from Alcatraz, Blue and Gold could fold,” said David Heran, an International Boatmen’s Union member and deckhand since 1974 who applied to Hornblower but wasn’t hired. “I’m not ready to retire yet, and this wasn’t the way I was expecting it to happen.” SFBG

Though Air America radio host Mike Papantonio (a Christian but not a fundamentalist) steps in from time to time as a de facto voice of reason, Jesus Camp operates without narration or slanted editing. It doesn’t need it. As is, the doc offers a clear-eyed view of a religion that might seem on the fringes but in fact claims huge, ever-growing numbers. The film also places emphasis on the palpable evangelical presence in American politics — with a chilling look toward the future, when this brainwashed-from-birth generation will eagerly join the right-wing voting bloc.

I spoke with co-director Heidi Ewing hours before Jesus Camp’s sold-out Times Square premiere Sept 22 (the film opens Sept 29 in San Francsico). She was understandably a tad nervous: “I’ve got some butterflies that I didn’t think I’d have, but I think that’s normal.”

Josh’s going-back-to-jail party at Crash

On the eve of Josh Wolf going to jail, and on the eve of Chronicle reporters Lance Williams and Mark Fainaru-Wada facing yet another federal decision moving them ever closer to jail, I was honored to be the lead speaker at the fundraiser and going-back-to-jail party for Josh last night at Crash, a club on Mason Street in San Francisco.

I made two major points: first, that this was the only city in the country to my knowledge that had three reporters who were in jail or heading to jail, on orders from Washington, for failing to produce sources and material in federal cases. This was no mistake. This was a direct hit at San Francisco, the country’s leading city for dissent and anti-war movements for decades, and came down directly from the Bush Administration and its PATRIOT Act politics as a way to scare the city and put its dissenters on notice.

My second point was that I was speaking as a member of many journalism organizations (from the Society of Professional Journalists, which has already contributed $30,000 to Josh’s defense, to the California First Amendment Coalition to the California Newspaper Publishers Association to international groups from the InterAmerican Press Association to the World Association of Newspapers to the International Press Institute) and that these professional organizations either are or would be in solidarity on this common ground journalism/public service issue. They could be counted on. But the Josh Wolf case was different because he was a lone freelance video photographer, without a news organization and attorneys behind him, and he looked like easy prey for the local cops and the feds.

That, I noted, was what was so important about the Crash event and the emerging Josh brigade. The event was lively, well attended, lots of fun, and demonstrated that a freelancer who stands tall, as Josh is doing, can build a strong grassroots constituency capable of mobilizing sustained resistance.

The real outrage is that the local cops turned Josh’s case over to the feds and gave them another timely target for Bush in San Francisco. And the cops did so secretly and unilaterally, without going to the mayor, to the supervisors, to the district attorney, to the Police Commission. The cops who are fighting like hell to keep beat patrolmen out of the neighborhoods and were happy to invite the feds to come to town and rough up our press and our public on their behalf. At minimum, that move demands public hearings by the supervisors to determine how this happened and what can be done to see that it never happens again.

Today’s Chronicle blaring front page head said: “SILENCE MEANS PRISON, JUDGE TELLS REPORTERS” No, silence in this case for these three reporters means principle and honor and holding your ground under fire. There is no principle or honor for the people in Washington who are working overtime to put in jail three reporters who were doing their job at this critical moment in the City and County of San Francisco.

None of the candidates for public office this year can beat the performance of a 2004 supervisorial hopeful who showed up at the Guardian office for an endorsement interview with a completely spaced-out homeless friend in tow. The candidate was talking rapid-fire for an hour, shifting effortlessly back and forth from his history as a welfare recipient turned bartender turned subject of a drug bust turned successful businessperson to his suggestions for public policy and proposals for improving the neighborhood. His pal was muttering the entire time, off in his own world, his random comments a kind of atonal counterpoint to the candidate’s high-speed pronouncements and reminiscences — until the would-be politician began to talk about the time years ago when the cops caught him with a bunch of LSD that wasn’t really his. Quite a bit of LSD. At the description of the inventory, the sidekick snapped out of his reverie for a moment and proclaimed, “That’s a lot of dose.” Then he was back to his own world.
The 2006 contenders are a much more predictable lot, generally speaking. But there have been some moments.
At the top of the list, I think, were Starchild, the Libertarian candidate for District 8 supervisor, and Philip Berg, the Libertarian for Congress, who came in together and told us that the city would be a much safer place if the entire populace were armed — not just with handguns but with AK-47s — and that the trouble-plagued Halloween Night in the Castro would be much more peaceful if everyone who attended had a weapon.

We generally don’t record interviews with people who just come down to the office to chat and give us advice about the election, which is fair — but I want to share a really sad moment with you. Sarah Lipson stopped by at my request to talk about the SF school board race; she’s one of the best members of that often-dysfunctional panel, the kind of person who gives you hope for the schools and for local politics … and she’s not seeking reelection. She misses teaching, she told us, and that’s understandable — but she also said that it’s basically impossible for someone with kids who isn’t rich to devote perhaps 30 or 40 hours a week to the school board and still have a job on the side.
Thing is, the San Francisco Board of Education, which oversees a half-billion-a-year budget, is essentially a volunteer ($500 a month) gig. That’s a model from a very different era, and it doesn’t work anymore.
San Francisco is a hideously expensive place, a city where almost nobody can support a family on one income. Full-time volunteerism is an impossible burden, and it means people like Lipson — who is exactly the sort of person we want setting policy for the schools — can’t serve on the board. Either you punish your family or you don’t do the job you want to do.
Being on the school board is a full-time job. We need to pay these folks a full-time salary. SFBG

Redefining radicalism

› news@sfbg.com The Ella Baker Center for Human Rights has a 10-year history — which it marked Sept. 14 with an anniversary gala in Oakland — of aggressive opposition to police abuse, racism, economic injustice, and the get-tough policies that have created record-high incarceration rates. Those problems have only gotten worse over the last decade, despite some significant successes by the group in both Oakland and San Francisco. But these days, founder and director Van Jones sounds more like a hopeful optimist than an angry radical. “When we first got started, our politics were more about opposition than proposition,” Jones told the Guardian. “We were more clear what we were against than what we were for.” An organization once prone to shutting down the halls of power with sit-ins is now working on prison reform legislation, doing antiviolence public education campaigns, and promoting the potential for a green economy to revitalize West Oakland and other low-income communities. “Now, I’m in a place where I want to see the prisoners and the prison guards both come home and get some healing,” Jones said. Some of that transformation comes from Jones’s evolving critique of progressive political tactics, which he has come to see as ineffective. “Our generation would be better if we had a little less New Left and a little more New Deal.” But the change was also triggered by a personal epiphany of sorts following his unsuccessful effort to stop the passage in 2000 of Proposition 21, which sent more minors into the adult correctional system. “I went into a major depression and I almost quit being an activist,” Jones, an attorney who turns 38 this month, told us. “It was a very personal journey, but it had a big impact on the Ella Baker Center.” The change has made allies of former enemies, like radio station KMEL, which was vilified for selling out the Bay Area hip-hop culture after Clear Channel Communications purchased the station, but which is now helping the Ella Baker Center spread its antiviolence message. The center has also attracted a new breed of employees to its ranks of 24 full-time staffers, people like communications director Ben Wyskida, who moved here from his Philadelphia communications firm last October. As he told us, “What drew me to the Ella Baker Center was this message of hope.” Jones has a critique of the problems and those in power that is as radical as ever, noting that authoritarians have taken power and essentially dismantled our democratic institutions. But he’s moved from diagnosis to prescription, telling us, “I think the ‘fuck Bush’ conversation is over.” His new approach hasn’t always gone over well with his would-be allies. Environmental groups including Greenaction boycotted Mayor Gavin Newsom’s photo-op posturing during World Environment Day last year, and they were critical of Jones for validating the event and using their absence to grab the media spotlight for his green economy initiatives. But Jones tells us he doesn’t get rattled by criticism that he’s playing nice with the powerful because he remains committed to helping the underclass. “The most important thing is to know who you’re for and know your history.” And if the group’s 10th anniversary black-tie celebration in the Oakland Rotunda was any indication, the Ella Baker Center has more support now than at any other time in its history. The guest list for the event was a veritable who’s who of every major political, grassroots, and environmental organization on the West Coast. Guests included Code Pink cofounder Jodie Evans, Mother Jones publisher Jay Harris, and actor-activist Danny Glover. “Radical means root — that’s what we have always been addressing,” Jones told us at the event. “We used to spend a lot of time pointing out the hurt in the community. Now we connect the points of hope.” To Jones, hope means tying the need to save the planet from global warming to the need for economic development in Oakland. “Let’s make it into job opportunities for poor people and build a green economy strong enough to lift us out of poverty. That’s hope. We want to take people out of the prison cells, into solar cells.” Jones’s allies see him as a silver-tongued visionary, a lighting rod who can bridge movements with apparently differing agendas. Activist Julia Butterfly Hill, a longtime friend and political ally of Jones, told us at the event, “Van shows he cares and he’s human, and he puts himself out there on the line. That’s why you saw this coming together. This is the voice, this is the conversation that the planet is literally dying for, and I really mean sick and dying for.” The evening, a spirited celebration of hope and achievement, gave influential friends a chance to size up where the group has been and where it’s headed. As Harris of Mother Jones told us, “Van is a big thinker. He really engages people’s imaginations in terms of what could be. There’s one way, which is to fight against the system. Van’s way is to reimagine the system.” There to bless the event, Glover warmly heaped his own praise on Jones by comparing him to the Civil Rights Movement worker who is the organization’s namesake. “When I think of Ella Baker and what she stood for, Van carries on that work, and I think that’s vital. We envision ourselves through the women and men that set a certain standard. Van sets a certain standard.” SFBG www.ellabakercenter.org

FEST REPORT I’m writing hours after the start of the Toronto International Film Festival’s 31st edition. Opening nights are a ritual for film festivals, and this one is no exception. The big show is always a Canadian feature: this year it’s Norman Cohn and Zacharias Kunuk’s The Journals of Knud Rasmussen, the follow-up to the same team’s hit from five years ago, Atanarjuat: The Fast Runner. I’ve seen the best and worst of Canadian cinema over the years at these opening nights, but I now choose to skip the red-carpet mob of Toronto’s moneyed finest in favor of an alternative: at the Elgin, one of Toronto’s best movie palaces, an international feature with high hopes unspools to an audience of cinephiles with equally grand expectations. To the collective joy of those assembled, The Lives of Others hits the giant screen with appropriate splendor. Already said to be Germany’s contender for the Oscars (a prospect that isn’t necessarily promising), this debut feature is much more than the usual polished Euro gem aiming at the global market. Director Florian Henckel von Donnersmarck studied political science and economics as well as filmmaking, and it shows. Here is a man who can think about his society and who, moreover, trusts the specificities of history (in this case, 1984 in the German Democratic Republic) to speak to the present. Like Good Night, and Good Luck, Henckel von Donnersmarck’s The Lives of Others begs us to pay attention to history. In Germany — the film suggests — the days of political thugs abusing power to control a population are over. “To think that people like you used to run a country!” its writer-protagonist explodes in a pivotal scene to an ex-politician in the lobby of a Berlin theater reviving the former’s old socialist realist play. Here in George W. Bush and Karl Rove’s America (where the wiretapping that dominates Henckel von Donnersmarck’s film is a reality), no such comforting escape into the present is remotely possible. But The Lives of Others could be a lesson to US filmmakers on how to create complex characters that lead an audience through complex issues — to think and feel at the same time, as the director’s compatriot Rainer Werner Fassbinder once put it. The Elgin Visa Screening Room (yes, that’s the name — festival sponsor Visa is inescapable) vibrated with passion at film’s end. Directors aren’t supposed to come back onstage at the opening-night screening, but the standing ovation demanded it. And the applause wasn’t only for Henckel von Donnersmarck’s very real achievement as the writer and director. Lead actor Ulrich Mühe — who gives an extraordinary performance as a conflicted Stasi agent — had been an East German theater actor under heavy Stasi surveillance. There he was, onstage too, a living storehouse of historical process. At a festival where politics are already emerging as a major focus, this jewel of a flashback may well be a flash-forward to the year ahead. (B. Ruby Rich) FEST REPORT I may be an American journalist scuttling around in Canada, but so far all of my top picks at the Toronto International Film Festival hail from Asia. South Korea’s The Host is a film you will be hearing a lot about in the near future — especially if you’re anywhere near my yapping mouth, which will be (loudly) singing the praises of Bong Joon-ho’s colossal monster jam for months to come. Kinda like The Texas Chainsaw Massacre, The Host is inspired by a true incident. According to a 2000 Korea Times article, an American civilian employee of US Forces Korea was jailed for ordering the dumping of toxins into Seoul’s Han River. That he happened to oversee a US Army mortuary was a particularly juicy detail. As The Host imagines it, the freaky chemical combo births an underwater mutant. We don’t have to wait long to get a full reveal either: it’s a huge, mouthy sea monster, complete with dexterous tentacles and the ability to gallop across land, perform graceful backflips, and swallow whatever unlucky human being gets the hell in its way. Naturally, the local population freaks — especially a sad-sack father (Song Kang-ho, who also played a sad-sack father in Park Chanwook’s Sympathy for Mr. Vengeance) who watches helplessly when his young daughter gets lassoed by the critter. The Host follows his oft-ridiculous plans to rescue her with the help of his brother (an educated drunk) and sister (a competitive archer who tends to choke when it counts). The film also chronicles the Korean government’s strong-arm approach to handling the “river incident” — with the help of the US Army, which would just as soon incite even more panic by claiming the monster is the source of a terrible and mysterious new virus. Bonus: The Host boasts killer special effects by San Francisco’s the Orphanage (Sin City, Superman Returns) and New Zealand’s Weta Workshop (The Lord of the Rings trilogy, King Kong). With cutting political and social commentary gurgling just below the surface and black humor spurting from every orifice, The Host (due for a Magnolia Pictures release in 2007) is a must-see for monster movie fans — and jeez, everybody else too. If straight-ahead action’s more your thing, keep an eye out for Johnnie To’s Exiled (Bay Area release date unknown). Touted in some circles as the sequel to The Mission, this may be the prolific To’s best gangster movie to date. The smashingly hangdog Anthony Wong anchors a cast of familiar Hong Kong faces (Simon Yam, Francis Ng, Nick Cheung); the plot, about hired guns and gangsters who do the double cross like nobody’s business, matters less than the jaw-dropping gun battles it produces. When shoot-outs come this well choreographed, the word is gun-fu — and in Exiled, the bloody results are nothing short of stunning. Also topping my Toronto experience so far: Takashi Miike’s latest oddity, surreal prison drama Big Bang Love: Juvenile A (by the time you read this, he’ll probably already have his next film in the can); The Wayward Cloud director Tsai Ming-liang’s dreamy, gritty, and near-silent I Don’t Want to Sleep Alone; and Nobody Knows helmer Hirokazu Kore-eda’s samurai yarn, Hana. A lot has happened since Californians first rebelled against the canned food and Jell-O molds of the postwar industrialization era. The American food politics revolution is very much alive and well and thriving in the Bay Area, where the movement started. And California is still the food basket of the United States — it’s been the top grower in the country for more than half a century. The dialogue about sustainable growing practices and environmental impact is open, and the fight for more mindful production practices is still on.
We are home to around 100 farmers markets — including Alemany, which, at 63 years old, is the granddaddy of local markets. Alice Waters’s groundbreaking Chez Panisse restaurant celebrated 35 years of organic-minded Epicureanism this year. CSAs (Community Supported Agriculture farms) — started in the United States in the 1980s — are going strong. Local groups and organizations that continue to educate and activate the revolution around here include but certainly aren’t limited to San Francisco Food Systems, Food Not Bombs, Food First, and the Brentwood Agricultural Land Trust, which protects farmland against development. Blogs like the Eat Local Challenge, written by authors across the United States, and resource Web pages like those of the Center for Urban Education about Sustainable Agriculture, the organization that runs the Ferry Building farmers markets, offer a plethora of information about the local food politics movement.
And then there’s Larry Bain — restaurateur, activist, and founder and executive director of Nextcourse. He doesn’t just eat his politics, he feeds them to the Bay Area. Bain has a hand in a few of the finest and fanciest restaurants in town (Acme Chophouse, Jardinière), but his work through Nextcourse in San Francisco jails and schools and with the Golden Gate National Recreation Area narrows “the food divide” and shows how eating well doesn’t mean breaking the bank for artisanal olive oil. We talked to him about his organization and some of the major issues it’s taking on in the quest to bring mindful eating practices to the larger community.
SFBG What inspired you to found Nextcourse?
LARRY BAIN I’ve been a food activist since 1983, when I opened [Zola in San Francisco] with the intention of creating a new model for restaurants. Restaurants use more energy per square foot than any other retail operation, so the consumption of water, gas, electricity, and the generation of greenhouses gases tend to have a very deleterious impact on the environment. Then there’s the cleaning solutions used in restaurants. And the amount of garbage generated, the packing, and then of course the stuff we know and think first about restaurants, where food comes from, the fossil fuels used in the creation and transportation of food. Every year I owned a restaurant, I got more excited about the positive impact restaurants could have and about finding ways to influence other restaurateurs. Because nobody wakes up in the morning and says, “I want to be the cause of 17 trees being felled in the redwood forest.”
But I wasn’t big enough to take it all on. Every issue is far more complex than you’d think. Whether it’s a straightforward Atlantic salmon or a Chilean sea bass, there are layers of impact. Even eating local — what does that do to communities that depend on people in America buying their coffee beans or some other product? I wasn’t sure where to focus until I went to a seminar that was given at the UC Berkeley School of Journalism. All of my heroes were up on the stage: Vanda Nashiva, Orville Schell, Wendell Berry, Michael Pollan, Carlo Petrini. They were being eloquent and brilliant about the future of food and where we needed to be going, touching many things close to my heart.
As always happens at one of those gatherings, some smart-ass stood up and asked, “Excuse me, if we were going to make the transition from conventional to organic tomorrow, would we still be able to feed the world?” It’s the argument always thrown out by Archer Daniels Midland: “This is the only way to feed the world, through genetically modified crops and by conventional methods of distribution. All of this organic stuff is just pie in the sky.” And everybody, all of my heroes said, “Oh yes, organic farming is superproductive. You get a lot more nutrients out of every acre planted.”
Berry said, “We just don’t have enough farmers. If you went to the unemployment office and said, ‘OK, all you three guys over there, tomorrow you’ll be organic farmers’ — it requires tremendous wisdom and experience and we’ve lost that. Before we can talk about changing our food system, we have to be cognizant of the supply, and we don’t have the farmers and we don’t have farmland.” It was at this point that I thought, OK, this is going to be my passion, growing farmers.
I don’t know anything about agriculture. My area of expertise is the world of commerce, and I know what farmers need is a good path to sell their product. And because farmers cannot survive through Chez Panisse alone, they need a broader base of consumers that might be willing to buy things that aren’t as exotic as a $5 peach but greens or even fruit that is delicious but not beautiful.
SFBG Has cooking become some exoticized thing?
LB Elitist thing. People go to the Ferry Building not to buy their food but to accessorize their meals, and so what they’re going to eat is pretty standard stuff that they might get at Safeway or Whole Foods, and then they go to the Ferry Building to get this little bunch of herbs or this little piece of cheese that will make it a special dinner. And so how do you make shopping in farmers markets and cooking for your family more of a way of life rather than a lifestyle. When you’re living in a neighborhood filled with tension and stress and toxic materials, food becomes even more important to help you survive that, to help you keep a strong immune system. So Nextcourse started in the San Francisco county jail working with women who are moms, mostly, and who, once they get out, need to feed their family.
SFBG When did the cooking in jail program start?
LB I got a phone call from a teacher at a school in Emeryville to come and talk to students there about healthy eating. I took the chef and sous-chef from Acme Chophouse, and we cooked with the kids. A friend of mine said this would be a great program at juvie hall. And so I called juvie hall — it was a bureaucratic nightmare. The same friend said, “Well, I know someone who does work at the county jail. She’s a public defender.” So, I called her up and told her, “We want to do cooking classes in the jail. I’ve got these great chefs, and they know how to show people how to cook things that are delicious, nutritious, easy, cheap, fun. Can you help us out?” Within a week we met with the sheriff, who loved the idea.
In the classes, we talk about the importance of nutrition and the how-to. A lot of these women know that eating good food is important for their kids. They know this, and yet they think, “What can I do about this? I can’t afford to go to Whole Foods, and I can’t afford to eat at Chez Panisse.” So we show them where to shop, and every class has a menu. The teacher will shop the day before, both at Safeway or FoodCo or one of these cheap stores and at a farmers market — not at the Ferry Building but at Heart of the City or at Alemany or sometimes just at stores in the Tenderloin. And we line the ingredients up side-by-side and invariably the ingredients from the farmers market, aside from being more nutritious and delicious, are cheaper because we shop seasonally.
All of the cooking takes place with minimal equipment. In the jail we can’t use knives. Everything can be done — a salad, a main course, a vegetable — in 25 minutes, and for less than $5 a person. Cooking quickly is all about being organized. We teach them those skills as well.
SFBG How many women have gone through this program?
LB I think it’s about 750 now. One of the things that we’re moving forward with is finding a way to connect with the women after they leave. One of the new initiatives is working with a postrelease program where there’ll be a kitchen so we’ll be able to do the classes on an ongoing basis.
SFBG Something that a lot of people don’t know is that people who have a felony drug offense can’t get food stamps.
LB It was part of that whole clean up drugs thing. It’s changed slightly so that now if you have a minor drug offense, you can get food, but if you have a heavier felony offense, it’s still not possible. [Assemblymember] Mark Leno is working on fixing it.
SFBG Have you kept in touch with the women from the program?
LB Yeah. We have one woman who found us because we also offer the courses to women who provide day care. She told us, “When I was in jail, I was thinking this was all bullshit. I can’t do that. It’s going to be too expensive. It’s just you white people blowing smoke up our ass. But I got out and now I’m going to the market every week and my kids love it.”
SFBG You’re also coordinating food service for the Golden Gate National Recreation Area?
LB Yes, coordinating purchasing so the prices are better, but also coordinating so some people can get products that there hasn’t been enough demand for. The great thing about McDonald’s is that it represents this huge buying power, and if McDonald’s says, “We want an alternative to Styrofoam,” people say, “OK, we’ll do that.” So when 17 food services here say, “We really want cornstarch knives or sugar-based packaging material” … companies will see this opportunity and figure it out.
I started talking to the people in the national park for two reasons. One is that the park feeds a lot of people. Golden Gate Park is 75,000 acres, the largest urban park in the country, and feeds 17 million people a year, whether they’re dining at Greens, which is a park partner, or the Cliff House or some little café. The park also sits on a tremendous amount of good agricultural land, some of which is being used up at Point Reyes National Park. Cowgirl Creamery, Strauss Dairy, Hog Island Oyster, Sun Farm — all those are on park land. We want the park to become not only a purchaser of good sustainable, healthy food but also a producer.
SFBG One of the reasons why Nextcourse is interesting is that it addresses the “food divide,” actually doing outreach into the community that is not going to show up at the Ferry Plaza Farmers Market. What do you think needs to be done? It feels like the gap is getting wider rather than narrowing.
LB That just represents what’s happening in our society. Truly, you can’t change the food system without looking at every other aspect of the economic system. You’ve heard it before, but there’s all these wonderful catchphrases like “the high cost of cheap food.” People shouldn’t be asking why this beautiful piece of fruit is so expensive, they should be asking why this other piece of fruit is so cheap. And the reason it’s cheap is because of the way our economy is structured, with lobbies, subsidies, and oil companies having such a strong vested interest. The real problem with food costing “X amount” is that we can’t survive just on food. We need housing, we need education, we need health care. The government is no longer in the public service business: they’ve privatized all of those things, and they’re driven by profit. People can’t afford more expensive food because they’re spending so much on rent, health care, and more expensive schools.
We’ve created a society that’s increasingly divided the rich and the poor. Food is just symbolic. If we want a just society, this is just one aspect — don’t stop at food, but see food as the beginning, a way to engage in a better world.
SFBG What about the conceptual problem? It’s fine to repeat the mantra that cheap food is more expensive, but when it’s not immediately visible …
LB We’re encouraged to not see beyond our own noses. It’s not in the interest of economy for us to think of long-term effects, to see the net. We just see “cheap.” This is the money I have in my pocket at the moment. I’ll worry about the hospital when I have to go to a hospital, and in fact, it’s best not to think about that. So in order for things to change, food people need to see that while they need to collaborate among the food community, they also need to collaborate among the social justice community as a whole. The food community has to see that people struggling for immigration rights, workers’ rights, health care rights are their natural friends.
SFBG What are some organizations around the Bay Area that are doing good work?
LB On a really grassroots level, I think la Cocina is fantastic — an industrial kitchen facility that brings in mostly Latina women with the hope that they’ll be able to have their own kitchen or restaurant someday. The Columbia Foundation, particularly through their Roots of Change program. Something new to the Bay Area is the Community Alliance for Family Farmers that is trying to bridge the gap between farms and urban centers.
SFBG What are the top issues facing the Bay Area — in terms of food and our ecology — in the next decade?
LB The offshoring of our food production. It’s going to happen unless we start yelling and screaming, because it is so much cheaper to grow and produce food in developing nations. A lot of these agribusiness companies want to get out of the US. They want to be someplace where there are no labor laws, there are no environmental restrictions. That’s what keeps me up at night. I wake up in the middle of the night screaming, “They’re offshoring our food production.”
Environmentally, water is the biggest issue that we’re facing. What’s happening is that farmers are saying, ‘I could sell my water for much more money than I could ever make growing food.’ Because all of our communities, particularly those built in deserts, are so desperate for water that they will pay anything for it. So as water becomes more politically contentious and expensive, anybody doing agriculture will go someplace where there isn’t necessarily more water but they can get it for free or get it illegally. Despite Mayor Gavin Newsom’s rhetorical efforts to dismiss the importance of ideology in San Francisco politics, this is a town the is deeply divided between progressives and Establishment moderate-to-conservatives. And the battle we fight is an important one that will determine whether San Francisco remains open to low-wage workers, tolerant of diversity, and a leader in combatting the dismal and divisive policies being perpetrated on the state and federal levels.
OK, OK, maybe y’all know that. But to get more insights in where the battlelines are drawn in San Francisco — right down to the level of individual precincts and neighborhoods — you’ll need to spend a little time studying the latest version of the Progressive Voters Index. Kudos to political scientists Rich DeLeon and David Latterman — and the good folks over at www.sfusualsuspects — for providing this valuable resource.

There are people at the daily newspapers around here who bristle when I accuse them of ignoring important local stories, particularly ones involving powerful political, business, or social figures (and most particularly, involving the newspapers themselves). No representative of the Hearst Corp. stands in the newsroom door announcing that stories about management will be sent to New York for prior censorship. Nobody tells the Chronicle’s reporters that they can’t cover a pressing story.
And I believe all that. I really do. I know it doesn’t work that way.
Carl Jensen knows that too. When he started Project Censored back in 1976, he knew he’d get a lot of criticism. “Censored” is a pretty strong word; it evokes a mirthless military guy with a pair of scissors and a big black pen, preventing real news from emerging out of a pressroom bunker somewhere.
But what Jensen has been trying to say for years is that the stories cited by Project Censored represent choices made by editors and publishers about what’s important in today’s world. That’s what the front page of a newspaper is — a set of choices. Is the confession of the purported killer of JonBenet Ramsey more important than the Bush administration’s illegal wiretapping of millions of Americans? Is the latest news about Brad and Angelina more important than the latest news from Iraq? Is one man’s quest to take control of every daily newspaper in the Bay Area worth more than a first-day story and a few tiny news briefs?
Editors are paid to make those decisions — and the ones who want to keep their jobs know what the rules are. That’s why some stories get more coverage, more play, and more attention and some get deeply buried or published in one place and never picked up by anyone else.
Anyone who reads political blogs knows about stories like the ones on this year’s Project Censored list (see page 15). Nobody blacked out the news with a big rubber stamp; it just never got reported in the first place.
For a Sunday afternoon on a Labor Day weekend, it was truly impressive: I counted at least 300 people at the Delancey Street events room for the Sue Bierman memorial. Just about everyone on the local left seemed to be there, along with a few luminaries like John Burton, Gavin Newsom, and Willie Brown, who were Bierman’s friends even when they were wrong and she was right.
Newsom, who was often at odds with Bierman, looked out over the crowd and made the point succinctly: “This is what happens,” he said, “when you’re nice to people.”
There were many funny and moving stories. Burton, who showed up in his usual sartorial splendor (striped sweatpants and an untucked shirt, which makes me respect the guy as much as anything he’s ever done in politics) talked about how Bierman always, always enjoyed herself, even in the most boring political drudgery. It was wonderful to see her children, grandchildren, and great-grandchildren there (and wonderful for them to see how many people were part of Bierman’s San Francisco community).
Calvin Welch, her Haight Asbury neighbor, friend, and longtime comrade in arms, reminded us all that Bierman “created the neighborhood movement in San Francisco” — and that she did it in her own style, always believing that “fun is important.”
A lot of people go to political funerals because they have to; most of us went to this one because we wanted to. Thanks, Sue. SFBG

After William Randolph Hearst flunked out of Harvard in the 1880s, he pursued a new career path, asking his wealthy father for only one thing: the San Francisco Examiner.
Young William didn’t stop with the Examiner — over his lifetime, he accumulated dozens of newspapers nationwide. Eventually, one in five Americans regularly read a Hearst paper.
That seems like a lot of power and influence, and it was. But it’s nothing compared to what the heirs to Hearst’s media mogul mantle are doing today.
In fact, the Hearst Corp. is working with another acquisitive newspaper magnate, William Dean Singleton, to lock up the entire Bay Area daily newspaper market. If the project succeeds, one of the most sophisticated, politically active regions in the nation may have exactly one daily news voice.
That worries Clint Reilly.
The political consultant turned real estate investor has sued the Hearst Corp., owner of the San Francisco Chronicle, for the second time in a decade to stop a partnership he fears will eliminate the variety of voices among newspapers in the Bay Area.
It’s an amazing story, full of politics, big money, secretive arrangements, and juicy executive bonuses. What’s at stake? Control over one of the most lucrative businesses in Northern California.
But for the most part, you aren’t reading about it in the daily papers — which means you aren’t seeing it on TV or hearing about it on the radio.
In fact, the blackout of the inside details of the Singleton deal and Reilly’s effort to stop it is one of the greatest local censored stories of the year — and the way the press has failed to cover it demonstrates exactly what’s wrong with monopoly ownership of the major news media.
The story began in the spring when one of the nation’s more respected newspaper chains, Knight Ridder, was forced to put itself up for sale after Bruce Sherman, a prominent shareholder, decided that the company’s relatively healthy profit margins (and dozens of Pulitzers) were simply not enough.
It’s the nature of publicly traded companies to be vulnerable to shareholder insurrections, unless they have multiple classes of stock. Knight Ridder didn’t, and although its former chief executive, P. Anthony Ridder, later said he regretted the sale, Knight Ridder went on the block.
The Sacramento-based McClatchy chain bought the much bigger Knight Ridder but needed to sell some of the papers to make the deal work.
In the Bay Area, Knight Ridder’s two prime properties, the San Jose Mercury News and the Contra Costa Times, were bought by MediaNews Group, the Denver-based conglomerate run by Singleton. That was a problem from the start: Singleton already owned the Oakland Tribune, the Marin Independent Journal, the San Mateo County Times, and a series of smaller local papers on both sides of the bay. The two former Knight Ridder papers would give him a near-monopoly on daily newspaper ownership in the region; in fact, there was only one daily in the area that would be in a position to compete with Singleton. That was the San Francisco Chronicle.
But in one of the strangest deals in newspaper history, Hearst — the erstwhile competitor — joined in the action, buying two of the McClatchy papers (the Monterey Herald and the St. Paul Pioneer Dispatch) and then immediately turning them over to Singleton, in exchange for some stock in MediaNews operations outside of California.
When news of the transactions first broke, MediaNews publications and the Hearst’s Chron covered it extensively, more than once putting the billion-dollar partnership on the front pages. (The transactions also involve a company formed by MediaNews and two of its other competitors, the Stephens Group and Gannett Co., called the California Newspapers Partnership.)
Since then, however, coverage has been overshadowed by JonBenet Ramsey and local crime news. The real story of what happened between Hearst and Singleton and how it would devastate local media competition never made the papers.
If this had been a deal involving any other local big business that had a huge impact on the local economy and details as fishy as this, a competitive paper would have been all over it. And yet, even the Chron was largely silent.
In fact, when Attorney General Bill Lockyer decided not to take any action to block the deal, the Chron relegated the news to a five-paragraph Reuters wire story out of New York, buried in the briefs in the business section. The original Reuters story was cut; the news of Reilly’s suit and his allegations didn’t make it into the Chron version.
At times, the new Singleton papers have treated the story with upbeat glee: in early August, the Merc proclaimed in a headline that the area’s “New media king is having fun.”
The story noted: “MediaNews is privately held, a step removed from the Wall Street pressure that forced the Mercury News’ previous owner, Knight Ridder, to put itself up for sale…. Singleton is its leader, and by all accounts, a man who lives, breathes and loves newspapers.”
Longtime media critic and former UC Berkeley journalism school dean Ben Bagdikian, author of The Media Monopoly, told the Guardian that most of the coverage so far has focused on the business side of the transactions.
“The coverage I’ve seen has simply described the devices they used to divide the McClatchy chain and did not describe how cleverly it was designed to avoid an antitrust action,” Bagdikian said.
Here’s some of what the daily papers have ignored:
The Hearst deal was certainly good for MediaNews, because on the same day the agreement was signed, top executives at the company were awarded $1.88 million in bonuses. MediaNews president Joseph Lodovic earned the chief bonus of $1 million, while the president of MediaNews Group Interactive, Eric Grilly, received over $100,000 in bonuses on top of a $1.25 million severance package for retirement. The figures were disclosed in the company’s most recent Securities and Exchange Commission filing.
Hearst has insisted repeatedly that its investment in MediaNews involves only tracking stock, meaning its up-and-down value rests solely on the performance of MediaNews businesses outside of California. Such a structure may help the two companies comply with antitrust rules — for now.
But in a little-noticed footnote included in a July memo filed by Hearst in response to Reilly’s lawsuit, the company revealed that its tracking stock could still be converted to MediaNews common stock in the future — meaning it would then have a stake in the entire company, including its Bay Area holdings. “The tracking stock will be convertible into ordinary MNG common stock, but that will require a separate, future transaction and its own Hart-Scott-Rodino review,” the July 25 document states.
In other words, public records — information freely available to the 17-odd business reporters at the Chronicle — show that Hearst’s fundamental presentation of the deal is inaccurate. Hearst is not just a peripheral player in this deal; the company is a direct partner with Singleton and thus has no economic incentive whatsoever to compete with the Denver billionaire.
And that means there will be no real news competition either.Reilly has been in politics most of his adult life, and he knows what happens when one entity controls the news media: perspectives and candidates that aren’t in favor with the daily papers don’t get fair coverage.
Newspapers, he told us recently, are charged with checking the tyranny of government; without competition they will fail to check the tyranny of themselves.
“The combination intended to be formed by these defendants constitutes nothing less than the formation of a newspaper trust covering the Greater San Francisco Bay Area,” Reilly’s suit states, “implemented through anticompetitive acquisitions of competing newspapers, horizontal divisions of markets and customers, and agreements not to compete, whether expressed or implied.”
A federal judge recently tossed Reilly’s request for a temporary restraining order against the Hearst transaction. But Reilly’s overall lawsuit, designed to stop Hearst’s $300 million investment in MediaNews, will still wind its way through the courts, and Judge Susan Illston signaled in her last order that she would “seriously consider” forcing MediaNews to give up some of its assets if the court finds the company’s transactions to be anticompetitive.
There are clear grounds to do that. In fact, as Reilly’s attorney, Joe Alioto, points out in his legal filings, the monopolists have made the argument themselves. When Reilly sued to block the Examiner-Chronicle deal in 2000, Hearst, which wanted to buy the Chron and shutter the Examiner, argued that closing the Examiner would have no competitive impact — since all the other competing Bay Area papers provided the reader and advertiser with a choice. Now the lawyers are arguing just the opposite — that the Chron and the outlying papers never competed in the first place.
Hearst will more than likely argue in court that since its newspapers face unprecedented competition from online content, there’s technically no such thing as a one-newspaper town. The world is globally connected now, this thinking goes, and the Chron and MediaNews both face competition from popular blogs such as Daily Kos and Valleywag on the West Coast and Gawker and Wonkette on the East Coast.
But that ignores a media reality: for all the power and influence of bloggers and online outlets, daily newspapers still have the ability to set the news agenda for a region. Among other things, local TV news and radio stations regularly take their cues from the daily papers — meaning that a story the dailies ignore or mangle never gets a real chance.
MediaNews argues in its most recent memo to Judge Illston that “any potential anticompetitive effect of the transactions against which the Complaint is directed is greatly offset and outweighed by the efficiencies that will result from those transactions.”
“Efficiencies” isn’t actually defined, but if the past is any indication, jobs could be the first place MediaNews looks to “efficiently” save money for its investors — at the cost of performing the traditional role of a newspaper to monitor government.
Reporting — real reporting — is expensive. It requires experienced journalists, and a good paper should give them the time and resources not only to watch day-to-day events but also to dig deep, below the headlines.
That’s not the monopoly media style.
Speaking in general terms, Jon Marshall, who runs the blog Newsgems and teaches at Northwestern University’s Medill School of Journalism, wrote us in an e-mail that newspapers have to be willing to invest in innovation now, while there’s still time.
“If newspapers really want to win back readers, they’ll need to start offering more outstanding feature stories that really dig deep and have a big impact on their communities,” Marshall wrote. “Readers need a reason to turn to newspapers rather than all the other content that’s now available through the Web. Newspapers will have a hard time creating these outstanding stories on a consistent basis if they keep paying their current skimpy entry-level salaries.”
The pattern Singleton is known to follow isn’t unique. A recent survey conducted by journalism students at Arizona State University revealed that the nation’s largest newspapers are giving reduced resources to investigative and enterprise reporting as media companies trim budgets to maintain or increase profits. More than 60 percent of the papers surveyed, the report stated, don’t have investigative or projects teams.
Brant Houston, executive director of Investigative Reporters and Editors, told us that while teams of reporters dedicated exclusively to investigations may be disappearing, many papers are willing to pull staffers away from their regularly assigned beats to make sure that big stories are thoroughly covered. But, he said, Wall Street’s haste to make money could backfire if readers head elsewhere in search of more exclusive content.
“I think everything is in flux right now,” Houston said. “Everyone’s trying to figure out what the next newsroom looks like.”
Luther Jackson, an executive officer of the San Jose Newspaper Guild, which represents staffers at the Merc, said it’s too early to determine the impact of MediaNews on the paper. The union just recently began new contract negotiations with the company, while the previous agreement, which expired in June, remains in place. Jackson said he didn’t believe the Merc’s Silicon Valley readers would tolerate any dramatic dip in quality coverage.
“We have a problem with the idea that you can cut your way to excellence,” Jackson said.
Just six years ago, after Reilly sued Hearst the first time to stop its purchase of the Chronicle and subsequent attempt to shut down the Examiner, trial testimony revealed that the Examiner had, in fact, abused its editorial power to advance its business interests. Examiner Publisher Tim White admitted in open court that he had traded favorable editorial coverage to then-mayor Willie Brown in exchange for his support of the Chronicle purchase.
Reilly lost that one — but for now this case is moving forward. The suit could be the last legal stand for people who still think it’s wrong for one person to dominate the news that an entire region of the country depends on — and at the very least will force the story of what really happened out into the open. The hitman cometh

There’s a key phrase in this morning’s New York Times account of the Mike Lacey massacre at the Village Voice (“Village Voice Dismisses 8, including Senior Arts Editors, a ‘reconfiguration’ leaves the critic Robert Christgau unemployed”). Click here

It followed the standard boilerplate press release that always accompanies what a former Voice press critic Cynthia Cotts called “the signature New Times bloodbath.” The boilerplate: Village Voice Media/New Times/Mike Lacey described the layoffs as an effort to “reconfigure the editorial department to place an emphasis on writers as opposed to editors.” The company added: “Painful though they may be in the short term, these moves are consistent with long-range efforts to position the Voice as an integral journalistic force in New York City.”

Then comes the standard line that is widely known to all of us who have tried in vain for years to get Lacey, the editor in chief of VVM/NT and the l7 paper chain from Phoenix, Arizona, to respond on the phone or by email to legitimate news issues:

Lacey “did not return calls seeking further comment.”

Lacey is a colorful editor. After New Times purchases a paper, he loves to ride into town and shoot up the saloon
and massacre the staff and the paper. He did this in San Francisco when the New Times bought the SF Weekly and he did it with the Voice in New York. He loves to whack away at me and the Bay Guardian with long screeds (his latest, a 20-pager of high volume vitriol up on the web somewhere, with the head, “Brugmann’s Brain Vomit, cleaning up the latest drivel from San Francisco’s leading bullgoose looney.”) It full of marvelous stuff and is one of my prized possessions.

But Mike and the New Times folks have a fatal flaw: They love to hit, run, and hide.

That’s how I started guerrilla blogging awhile back. The local version of Lacey’s journalistic ethics, the SF Weekly, would through the years blast away at me and the Guardian and our issues with a distinct pattern: they rarely would call for comment before publication. When they did call, they would get the quote wrong or out of context. And, when we would write a letter to the editor to correct the quote or get our point out, they would refuse to run the letter and would not explain why.

So I started doing some guerrilla blogging and sending my points by email to the SF Weekly/New Times people-and, of course, to Mike safely hunkered down in his foxhole in Phoenix.

The classic was when the SF Weekly/New Times/Lacey gave me a Best of award in 2003 for “Best Local Psychic.” It read: “Move over, Madam Zolta, at least when it comes to predicting the outcome of wars, Bruce-watchers will recall with glee his most recent howler, an April 2 Bay Guardian cover story headlined ‘The New Vietnam.’ The article was accompanies by an all caps heading and a photo of a panic-stricken U.S. serviceman in Iraq, cowering behind a huge fireball. The clear message: Look out, folks; this new war’s gonna be as deep a sinkhole as the old one. Comparing a modern U.S. war to Vietnam-how edgy! How brilliant! How original! And how did the prediction pan out? Let’s see now: More than 50,000 U.S. soldiers got killed in Vietnam vs. about l00 in Iraq. Vietnam lasted more than l0 years; Iraq lasted less than a month (effectively ending about two weeks after the story ran.) Vietnam destroyed a U.S. president, while Iraq turned one into an action hero. Well, you get the picture. Trying to draw analogies between Vietnam and Iraq is as ridiculous as Brugmann’s other pet causes. Scores of reputable publications around the nation opposed the Iraq war, but did so in a thoughtful, intelligent manner. Leave it to the SFBG, our favorite political pamphlet, to help delegitimize yet another liberal cause. Bush, Rumsfeld, and Ashcroft send their sincerest thanks, Bruce.”

Three years later, the war drags on, “reputable publications” all over the country are calling it another Vietnam–and Lacey and his Best of writers and editors look like fools and we still don’t know what the Lacey/New Times position is on Bush, the war, and the occupation. But this is vintage Lacey and vintage New Times politics distilled into their publication run largely on a centralized format out of Phoenix. The key point: the article was not bylined and I tried, again and again by guerrilla email and phone calls to Lacey and his SF Weekly editors, to get someone to say who conceived, wrote, and edited the item. Nobody would fess up. But I was told reliably that the writer was the cartoonist Dan Siegler and the editor was John Mecklin, then reported to be Lacey’s favorite editor and hand-picked by Lacey to take on the Guardian in San Francisco. I confronted them with emails, asking for confirmation or comment. I have not gotten any to this very day.

Alas, that in a nutshell is the political and journalistic and ethical policies that Lacey and the New Times have imposed on the Voice. No more liberal politics. No more James Ridgeway in Washington. No more Press Critic Syd Schanberg and no more press clips columns. No regular section criticizing the Bush administration and the war. No more editorials and no more endorsements and no more legendary Voice thundering away on the major New York and national issues of the day that cry out for a strong news and editorial voice from the Left.

And, according to the Times story, Voice layoffs and firings that “decimated the senior ranks of its arts staff,” including theater editor Jorge Morales, dance editor Elizabeth Zimmer, senior editor in charge of books Ed Park, art director Minh Uong, and Robert Cristgau, 64, who as a senior editor and longtime pop musit critic “helped put the Voice on the map,” as the Times put it. Cristgau had been with the Voice off and on since l969 and is quite rightly known as the dean of the Voice.

No more Village Voice as we have known it through all these years.

Instead, the Voice has Mike Lacey. I last ran into Mike at the annual business meeting of the Association of Alternative Newsweeklies (AAN) in Little Rock in June.
I held out my hand for a handshake and said, in a friendly way, “Mike, how are you doing?”
He stopped, looked at me, and said, “Bruce, Go fuck yourself.” And he turned and scampered off, never to return to the meeting and never to come near me again.

Mike, get out out of your bunker and give people a chance to ask you some questions. Start a blog.

P.S. We had fun with the Best of issue. We did a counter Best of, a full page ad, titled “Best Premature Ejaculation,” a special award to the editors of the SF Weekly/New Times.
We ended with this note: “Sorry, folks: WE wish the war in Iraq were as neat and tidy as you, Bush, Rumsfeld, and Ashcroft would like to think it is. But you, um, spoke too soon.”

Our postscripts drove home the points about Lacey’s style of hit and run journalism.
“PS: The real mystery of the city: who wrote the SF Weekly piece? Who assigned it? Who edited it? We’ve been calling, writing, e-mailing, and faxing the local office and corporate headquarters in Phoenix, but nobody will tell us.”

“PPS: Gee, what’s the New Times position on the war, anyway. We can’t seem to figure it out.”

And, let me add in retrospect, what was their position on Bush’s reelection? Well, as far as I can tell, the only endorsement published in any New Times paper came at the end of their syndicated sex column by their gay sex columnist Dan Savage just before election day. Dan, bless his heart, came out for Kerry and is now pushing publicly for impeachment. Where’s Mike? Mike? Mike? B3

I’ve been around a long time in city politics, and seen a lot of strange things, but even by my standards, it’s pretty darn wierd to see the Bay Area Reporter, a queer community paper, taking issue with the fact that a candidate for supervisor dresses in (mildly) outrageous clothes at Burning Man — and (gasp!) admits she might have even taken drugs at that annual desert party. Lordy, lordy, she even calls herself a “freak.”

Nice to see that Robert Haaland, who had endorsed Dufty, agrees with me that it’s “distasteful to hear politicos make snide remarks about her, about her attendance at Burning Man, and about her fondness for freaks.”

Has District 8 become so straight that the folks there can’t handle a “freak?” Even in these uber-gentrified days, that’s pretty hard to imagine.

Cops out of their cars

EDITORIAL The politics of crime can be tricky for the left: progressives are against far-reaching and punitive crackdowns, against police abuse, against the pervasive financial waste in law enforcement … and sometimes can’t come up with answers when neighborhoods like Hunters Point and the Western Addition ask what local government is going to do to stop waves of violence like the homicide epidemic plaguing San Francisco today.
So it’s encouraging to see Sup. Ross Mirkarimi, a Green Party member representing District 5, taking the lead on demanding more beat cops for the highest-crime areas in town. Mirkarimi’s not pushing a traditional reactionary approach of suggesting that the city hire more police officers and lock more people in jail; he’s advocating a simple — and decidedly progressive — approach to the issue. He wants the cops out of their cars and on the streets. On foot.
The idea of beat cops and community policing isn’t new at all; in fact, it’s the modern approach of highly mobile officers in cars, dispatched by a central computer and radio system in response to emergency calls, that’s a relatively recent trend. Police brass love it — they can cover more ground with fewer troops — and a lot of patrol officers like it too. They have that big metal car to protect them from potentially hostile criminals, and they don’t have to interact every minute of every day with the people on the streets.
But cops walking the beat are a proven deterrent to crime — and that’s not merely because of their visible presence. Properly trained and motivated community police officers can forge ties with merchants, residents, and neighborhood leaders. They can figure out where problems are likely to happen. They can become an asset to the community — not an outside occupying force that residents neither trust nor respect.
It’s a crucial change: right now, one of the biggest problems the San Francisco Police Department faces in solving homicides is the unwillingness of witnesses to come forward, in part because of a general mistrust of police. When there’s a killing, homicide detectives appear as if out of nowhere, demanding answers; it’s little wonder nobody wants to talk to them.
We recognize that beat patrols won’t solve the homicide crisis by themselves. That’s a complex socioeconomic issue with roots in poverty and desperation, and a couple of folks in blue on the street corner can’t alleviate decades of political and economic neglect.
And we also realize that it can be expensive to put officers on foot — they can’t respond as fast, and it takes time to develop community ties. But Mirkarimi isn’t asking for a total overhaul of the SFPD’s operations. He’s asking for a modest pilot program, a one-year experiment that would put two foot patrols a day in the Western Addition, focusing on areas with the most violent crime. The ultimate goal, Mirkarimi says, is to create a citywide beat-patrol program.
It won’t be easy: the department seems to be pulling out all the stops to defeat Mirkarimi’s proposal, which will come before the Board of Supervisors on Sept. 19. The Police Commission needs to come out in support of Mirkarimi’s proposal and direct Chief Heather Fong and her senior staff to work to make it effective.
The supervisors, some of whom worry that beat patrols in high-crime districts will mean less police presence in other areas, should give this very limited program a chance. Nothing else is working. SFBG

I was out of town when Sue Bierman died Aug. 6, her car crashing into a Dumpster near her Haight Ashbury home, in the neighborhood she loved. I was out of cell phone range and had no real Internet access, and the papers in Upstate New York didn’t carry the story. So I didn’t learn until I got home that San Francisco had lost one of its most vibrant, funny, warm, and passionate political voices.
Bierman, a native of Fremont, Neb., arrived in San Francisco in 1950. She was part of the first generation of urban environmentalists and was there at the birth of a movement that would change American cities forever.
The city that Sue Bierman adopted as her home was still largely a human-scale metropolis, a town coming out of World War II with a mix of blue-collar industry, a thriving waterfront, and a diverse population.
Her tenure as an activist tracked almost perfectly with the postwar assault on San Francisco by greedy real estate developers, speculators, and politicians who carried their water. She was part of the infamous freeway revolt, the successful effort by Haight residents to block a new elevated freeway that would have soared over part of Golden Gate Park. She was an early member of the anti–high rise crew that realized how intensive downtown development was going to turn San Francisco into another Manhattan. And when the late mayor George Moscone appointed her to the Planning Commission, she was a lonely voice for sanity through 16 years of development madness.
I first met her in 1983 when I was a young reporter covering planning and she was the only member of the commission who would ever come out against any major high-rise project. Over and over, she lost 6–1 votes.
When she was elected supervisor in 1990, she was not only a staunch environmentalist and neighborhood advocate but one of the few on the board at the time who really understood public power: as she would constantly remind her colleagues, she came from a state where electricity could never be sold by private entities for private profit.
And through year after year of brutal defeats, she kept not only her spirit but her sense of humor — and her personal warmth. She had none of the bitter anger that a lot of us took from that era. In fact, even when I criticized her both in private and in print for her loyalty to Willie Brown, she remained a friend. She never once had a harsh word to say to me.
A part of San Francisco passed when she died.
In other news: Supervisor Bevan Dufty insists he hates negative politics and won’t attack other candidates. And yet, the following appeared in Matier and Ross on Aug. 20:
“The campaign is barely under way, and already the mud balls are being lobbed. In this case, it’s a 1995 news clip from the Chicago Tribune describing how [Dufty opponent Alix] Rosenthal, then a 22-year-old senior at Northwestern University, abruptly resigned as student body president rather than face an impeachment hearing over a campaign finance scandal.
“Her sin: Exceeding the campaign spending limit by $26.06.”
Well, somebody dredged that up and leaked it to the press. Anyone you know, Bevan? SFBG

The flaws in the Josh Wolf case

Last week the California State Assembly and Senate unanimously asked Congress to pass a federal shield law to protect journalists from being forced to disclose unpublished material and the identity of a source.
Part of the motivation for the new push for federal legislation is the recent spate of federal attempts to imprison journalists who won’t give up their confidential sources. The latest victim of that crackdown, Josh Wolf, is in federal confinement after refusing to give prosecutors outtakes from a video he shot of a demonstration at which a San Francisco police officer was injured and a taillight was broken on a cop car (see “The SFPD’s Punt,” 8/23/06).
And while Congress is reviewing the case for protecting journalists, the Guardian has taken a hard look at the case against Josh Wolf — and it’s looking more dubious every day.
For starters, the local cops and the federal prosecutors are trying to claim that Wolf isn’t really a reporter.
That’s what sources in the San Francisco Police Department and the US Attorney’s Office tell us, and it’s borne out by the way the feds are pressing their case in court. In legal briefs, the government never refers to Wolf as a journalist, only as a witness. One federal official, who spoke on the condition he not be identified, likened Wolf to a convenience store owner who has a security camera that catches criminal activity on tape.
There are all sorts of problems with this argument — the first being that the courts have never formally contested Wolf’s journalistic credentials. In fact, the local prosecutors admit in legal briefs that they contacted Washington to seek permission to subpoena Wolf — a process that’s required whenever journalists face this sort of legal action.
As Peter Scheer of the California First Amendment Coalition points out, “The Justice Department claims it complied with regulations that say you can’t subpoena a journalist for outtakes without getting a special order from the attorney general.”
Scheer also notes that under California law, even bloggers enjoy the reporter’s privilege, as recently established when Apple Computer unsuccessfully tried to obtain the identities of sources who allegedly leaked business secrets to bloggers.
Lucy Dalglish, executive director of the Virginia-based Reporters Committee for Freedom of the Press, says that a case for Wolf qualifying as a journalist could be made under both the House and Senate versions of the Free Flow of Information Act, simply because Wolf was paid for broadcasting his video of the protest.
“In the Senate version, you have to be involved in journalism for money, make some part of your livelihood from it, while the House version is even broader,” said Dalglish.
Watching the part of Wolf’s video that he’s made public, which is posted online at www.joshwolf.net and was aired without his consent by at least three major TV networks before he was eventually compensated, it’s easy to speculate that the SFPD would not have delighted in the picture it paints of local law enforcement.
The footage of the July 8, 2005, protest begins peacefully with protesters, many of them wearing black ski masks, carrying banners saying “Anarchist Action,” “War is the Symptom, Capitalism is the Disease,” and “Destroy the War Machine.” As night comes on, the mood sparkles, then darkens. Someone lights a firecracker, smoke rises, helmeted police arrive, newspaper boxes are turned over, a Pacific Gas and Electric Co. office is sprayed with paint, and suddenly a police officer is captured holding a protester in what appears to be a choking position, while someone shouts, “Police brutality! Your career is over, fajita boy!” and an officer warns, “Leave or you’re going to get blasted. I’m a fed, motherfucker.”
At the same demonstration, Officer Peter Shields was hit in the head while charging into a crowd of protesters — and nobody knows exactly who hit him. That’s not on the public part of Wolf’s video, and Wolf and his lawyers insist there is no footage of the attack. Wolf fears that the government may be looking for something else — perhaps some video of other protesters — and will ask him to identify them. He refused to turn over the outtakes.
Carlos Villarreal, executive director of the National Lawyers Guild, says District Court Judge William Alsup, who ordered Wolf to jail, “made a big deal that Josh did not have agreement with a confidential source, but his argument turns Josh’s video equipment into a de facto government surveillance camera.”
Noting that there is a lot of trust between Wolf and protesters at demonstrations — “People aren’t afraid to go up to the camera and say, ‘Did you check out the pig that’s kicking a guy down the street?’” — Villarreal claims that “independent journalists are harder to see and spot than their corporate counterparts.”
The second, perhaps equally troubling problem is that the Wolf case should never have gone to the federal level in the first place.
Alan Schlosser, legal director of the American Civil Liberties Union of Northern California, told us there are a lot of red flags in the Wolf case, “beginning with the question, ‘Is there a legitimate federal law enforcement issue here?’”
The federal agents from the Joint Terrorism Task Force (JTTF) and the FBI didn’t choose to investigate the case — the San Francisco cops requested assistance. That in itself was odd: why is an assault on an officer a federal affair?
Schlosser asks, “Were the feds called in because they aren’t bound by the state’s reporter’s shield law?”
In theory, the local cops say it’s a federal issue because a cop car was damaged — and the city gets money from the federal government for law enforcement. Schlosser said it’s disturbing that “the SFPD doesn’t have to show the federal funds went towards paying for the allegedly damaged car…. So that statute could be applied to any number of situations. It’s very troubling. It federalizes law enforcement around demonstrations.”
A highly placed source in the SFPD offered a somewhat alarming explanation: the feds were brought in, the source said, not because of shield law issues but because the cops figured the JTTF and the US Attorney’s Office would move faster and more aggressively than San Francisco district attorney Kamala Harris, who has not been on the best terms with the local police.
In other words, if this source is correct, the SFPD is choosing who will prosecute crimes — based on politics, not the law.
As of press time, all Harris’s office was saying was that “the DA strongly believes in the First Amendment and the rights of the press. She also believes in justice for members of the SFPD. An officer was gravely injured that evening, and those responsible need to be held accountable.”
Asked why the federal government was involved in the investigation, Luke Macaulay, a spokesperson for the US Attorney’s Office, said, “This is not an attempt to profile anarchists and dissidents. It’s an attempt to get to the bottom of a crime.”
Macaulay also referred us to federal filings with the US District Court, which conclude that “the issue could not be more straightforward…. The incident is under investigation so that the grand jury can determine what, if any, crimes were committed.”
As far as we can tell, there’s nothing in writing that lays out when a San Francisco cop is allowed to ask for federal intervention in a case. All the SFPD General Orders say is that department members requesting assistance from an outside agency have to obtain the permission of a deputy chief.
According to records from the Investigations Bureau General Work Detail, Inspector Lea Militello filed a request for assistance from the FBI and JTTF to investigate a “serious assault against an SF police officer.” It was approved by Captain Kevin Cashman and Timothy Hettrich, deputy chief of investigations.
As of press time, the SFPD had not returned our calls inquiring why the FBI and JTTF were involved in an assault case, which is usually the domain of the DA’s Office.
David Campos, a member of the San Francisco Police Commission, said he thinks the commission needs to look at the issue “to make sure investigations are federalized when it’s appropriate and not as a way of getting around California’s shield laws.”
Reached Aug. 23 by phone in the Dublin Federal Correctional Institute, where he’s been held since Aug. 1, Wolf suggested that the feds are after more than pictures. “The Un-American Affairs Committee [in the 1950s] called in one person and forced them to make a list of all the people they knew. It was like Communist MySpace. So, I anticipate that they want all my contacts within the civil dissent movement.”
Wolf said he offered to let the judge view his video, which he insists does not capture the arson or assault. “There should not be a federal investigation. I published my video. They can use that to do their investigation.” SFBG
With all briefs filed, a decision on the Josh Wolf case is expected by Sept. 4.
