San Francisco’s not ready to make $118 million in budget cuts.

I realize the city can’t operate at a deficit, and if payment due exceeds accounts received, something has to be done. But it can wait a few weeks. In fact, the final decisions ought to wait for the new Board of Supervisors to take office in January. The city won’t go broke in the meantime.

But Mayor Gavin Newsom is rushing his cuts through, demanding 400 layoffs and taking a hatchet to the Department of Public Health. There are all sorts of alternatives — our editorial in this issue looks at how the city can bring in more revenue. There’s also a lot more sanity needed as the board and the mayor look at what could be devastating reductions in essential public services.

For example: I like the 311 program. It’s convenient. But I’d rather wait longer for my non-emergency call to be answered than to have public health workers lose their jobs. And the 311 budget hasn’t been touched.

Police and fire are, of course, essential — but it’s insane to give the cops and firefighters, who are among the best-paid city workers, a 7.5 percent pay hike this year while social service workers are getting laid off.

It’s lovely to have more fire stations per square mile than any other big city in California, but there are nowhere near as many fires as there were when the system was designed, and closing some down would save millions.

How come the mayor still has seven people in his press office, most of whom are paid to keep the press from finding out what’s going on?

Why are we talking about cutting the $800,000 Small Business Assistance Center, which actually helps the most important sector of the economy, when there’s $10 million, much of it redundant, in the mayor’s Office of Economic Development?

Why is Dean Macris, the former city planning director, still hanging around and getting paid?

Wouldn’t an across-the-board wage freeze be better than layoffs? What about capping the pay for city employees at $150,000 a year? What about capping police overtime?

What about having all these discussions in public, before the mayor sends out pink slips?

Or would that just make too much sense?

When Mayor Gavin Newsom walked across City Hall to the Board of Supervisors Chambers last week to announce that the city is facing a $576 million budget deficit, it looked as if he was putting political differences aside and genuinely inviting the board to "share the challenge" of bridging the 2008-09 budget chasm.

For years, voters and supervisors have urged Newsom to appear before the board for monthly policy discussions. And for as many years, Newsom has refused, claiming such invites were "political theater." Now that he’s finally made the trek, critics say the context makes the gesture more theatrical than substantive.

Within minutes of Newsom’s unannounced Dec. 9 visit to the board, City Hall insiders began to fear that the Newsom was only pretending to walk the unity talk: details of his $118 million in proposed mid-year solutions were not made available before the appearance, giving the two sides little to discuss and raising questions of due process.

"If the mayor was interested in real collaboration with the board, he would introduce his mid-year proposal to the board for our deliberation, just like the annual budget," Sup. Chris Daly told the Guardian. "But after we asked in three different ways, we found that he will be making over $70 million in cuts unilaterally — without the board’s approval. Now we have to figure out how to get the public a seat at the budget table."

Unlike during the normal budget process, the mayor has tremendous power to make cuts mid-year. But with details slow to emerge, the legislators weren’t the only ones left in the dark about the proposal, which includes slashing the Department of Public Health’s budget by 25 percent, cuts that DPH director Mitch Katz told the supervisors is going to require fundamentally changing how government runs.

Several City Hall workers told the Guardian how, in the days after Newsom made his budget deficit announcement, Controller Ben Rosenfield was seen running from department to department, trying to track down the program-level details.

Supervisor-elect John Avalos, who has a deep understanding of the budgetary process from his years as a legislative aide to former Budget Committee chair Daly, confirmed that the mayor’s $118 Million proposal "doesn’t tell you much."

"There is $47 million in increased revenue that has come in that offsets the shortfall, and there’s a higher-than-expected census at San Francisco General Hospital that allows us to recoup some money. But although there are all kinds of service/non-service cuts in Newsom’s proposal, we have no details to work with," Avalos told the Guardian.

Two days after his board appearance, Newsom penned an op-ed for the San Francisco Chronicle in which he again appeared to be holding out his hand to the board. But Avalos, a candidate for president of the board, observed that Newsom continues to protect his own pet projects, which include the 311 Call Center, the Community Justice Center, and the Small Business Assistance Center.

"The pain needs to be shared and minimized all round," Avalos warned. "The mayor needs to come forward and help us, not simply cut all the programs that the Republicans want to see cut. There is this huge backlash from folks saying, ‘Why do we spend $1 billion on our public health system? Maybe we don’t need public health.’ But our services are there for a reason."

Avalos said he worries that if we cut all these programs now, it will be very hard to get them back down the line. "When revenue is back, the focus will be on things that are important, but not on services that help the most vulnerable folks," Avalos predicted.

Within three days of Newsom’s appearance before the board, Peskin had figured out a mechanism whereby the public could weigh in on Newsom’s cuts: he introduced legislation that combines the mayor’s $118.5 million proposal with an alternative $8.5 million in cuts that Peskin has proposed.

"So, now there’s a de facto collaboration," Peskin told the Guardian. Peskin’s package of alternative cuts — which has since been pared back to $5.5 million because duplication with the mayor’s list was found — includes budget reductions in the Mayor’s Office of Economic and Workforce Development, Emergency Management Department, Fire Department, Police Department, Mayor’s Office of Criminal Justice, the 311 call center, and city grants to the opera, ballet, and symphony. Peskin is also proposed wage freezes that could save another $35 million.

Peskin’s counter-move allows the public to weigh in on the combined proposals. It requires department heads to publicly defend cuts to programs, services, and personnel — cuts that were developed, per Newsom’s request, behind closed doors. Or as Daly put it: "The mayor’s and the board’s proposals need to be deliberated not through a staff member to the mayor, but in full view of the public."

The board also wants to publicly discuss the layoffs, which Newsom said would total 399, a number that rose to 409 when the list was actually released. Peskin’s legislation also provides an avenue for fired workers or their representatives to publicly air discontent. A list of eliminated positions obtained by the Guardian shortly before press time shows that most of the positions were service providers making less than $70,000. Although union officials have complained that the ranks of highly paid managers has grown sharply since Newsom became mayor (visit sfbg.com for the complete list and more analysis).

SEIU’s Robert Haaland estimates that 75 percent of layoffs targeted line workers in service jobs. "As far as we can tell, the pain is all at the bottom," Haaland told the Guardian.

And while Haaland didn’t openly support Peskin’s counter-proposal — a citywide sliding scale of pay cuts in which the highest earners take a bigger hit and an across-the-board union wage freeze — he acknowledged that at least the proposal targets the powerful Police Officers Association and the Municipal Executives Association, and not just SEIU workers.

Haaland claims that under Newsom’s behind-closed-doors method, "the institutional bias of department heads tends to come into play" in making layoff decisions.

"It’s human nature. No one talks about it, and I don’t know that there’s a grand conspiracy," Haaland said, expressing his belief that it’s easier for managers to cut people they don’t work with than those around them or people at the top. "They also tend to target the union activists, the members who are a pain in the butt, and who they don’t like."

Newsom told the Chronicle in a Dec. 15 article that "labor is going to be a principal part of the solution." Tim Paulson, executive director of the San Francisco Labor Council, told the Guardian that "the SFLC is listening to its affiliates to see if there are any collective strategies." But Haaland observed that the city is "contractually obligated to the unions," which may further complicate ongoing negotiations.

With Sup. Bevan Dufty advocating to restore more than $500,000 in HIV/AIDS funding cuts and Sup. Sophie Maxwell is trying to avoid cuts at the Small Business Center, newly sworn-in Sup. David Campos stressed the need for a meaningful vetting process.

"It’s important for us to have a process that sheds light on the human impacts of the proposed cuts so we have a better sense of what it means to citizens of San Francisco," Campos said at a Dec. 12 board committee hearing.

Campos also made it clear that he is not afraid to target the arts, arguing that deep-pocketed patrons can help ease their pain, even as advocates countered that attacking entertainment will further deplete the city’s coffers by potentially hurting tourism. "As much as we appreciate the need to support the arts, we’re going to have to look at other avenues some of those folks can turn to, to get the funding that is needed," Campos warned. "People who have the greatest needs don’t have those options. "

With repeated rounds of painful cuts predicted in the next six months, Peskin told a Dec. 12 Government Audits and Oversight Committee hearing that it’s critical for the board to express its priorities. "These include keeping Rec and Park facilities open, providing basic mental health services, and preserving public sector jobs," Peskin said. "It’s also important that everyone share the pain, but not necessary that everyone share the pain equally."

Outside the meeting, laid-off worker Allanda Turner described her pain and the devastation she feels at being let go in the midst of a recession. "I’m a parent. I just purchased a home. I’m feeling almost no hope at all," said Turner, who fears she will be applying for the medical services, unemployment, and food stamps that she refers clients to as part of her job with the city’s Human Services Agency.

"The mayor always says he advocates for the poor, but we are the most underpaid," she said. Meanwhile, while her colleagues claim that their department "gave Newsom what he wanted" by adding layoffs to an original list of cuts that included fewer jobs.

"These are unit clerks, employment specialists, eligibility workers, and line workers," said Sin Yee Poon, a DHS contract manager. "Eight of them are child-protection workers."

There will be one last meeting of the current Board of Supervisors in January, and both incoming and outgoing members are already specuutf8g that unless Peskin’s legislation passes with a veto-proof majority, the mayor will veto it and this period of symbolic unity will come to an abrupt end.

"We have the capacity, the ingenuity, and the spirit to solve this," Newsom told the board. "It’s going to take all of us working together. It’s in that spirit that I am here. The mid-year solution — difficult and painful as it is — it’s the easy part. The difficult part comes in the next four months."

But as legislators explore the possibility of adding to their budget tools in the future through charter amendments and special elections, one aide stressed the importance of taking an active role now.

"It’s important for the board to set the stage now for the budget discussions in the spring."

Hustle in hard times

U Don’t Hustle U Don’t Eat, the appropriate title of the March 2009 album by up-and-coming Menlo Park-East Palo Alto rapper A.G. Cubano, pretty much sums up the state of the once vibrantly lucrative local rap music economy. Profit-wise, it has steadily slid and deteriorated during the past decade amid an extremely tough and competitive environment, forcing artists into creative ways of generating cash.

"It’s ugly out there," said Walter Zelnick of City Hall Records in San Rafael, which has distributed independent local hip-hop since its beginnings in the 1980s. "Numbers are down all around. The numbers of stores out there are down. I don’t think kids even buy CDs anymore." San Francisco’s Open Mind Music, which closed on Halloween, and Streetlight Records in Noe Valley, which closes Jan. 31, are just two of latest retail victims.

"Just getting in the stores is hard as fuck nowadays. I didn’t realize it had gotten so bad," said Dave Paul, whose prolific long-time local indie label just released the Bay Area artists-filled Bomb Hip-Hop Compilation, Vol. 2, a sequel to the 1994 premier volume, which sold way more than the "maybe 600 or 700 CDs" he expects to move of the new disc.

Zelnick also fondly recalls the golden 1990s when local rap compilations like D-Shot’s Boss Ballin’ (Shot, 1995) and Master P’s West Coast Bad Boyz: Anotha Level of the Game (No Limit, 1995) would sell in numbers that now often qualify as No. 1 on Billboard‘s national pop albums chart. "When [E-40’s group] the Click first came out, they were selling over a 100,000. But then sales for artists went down to 50,000 or 40,000," Zelnick said. Now "average CD sales are more like 2,000. And many people are lucky to sell that."

"It’s not as nearly as easy as it once was out here when we could fuck around and sell 50-, 60-, 70,000 copies independently," said longtime Fillmore rapper San Quinn who just released From a Boy to a Man (SMC) and will soon follow up with the collaborative Welcome to Scokland (Ehust1.com) with Keak da Sneak. "I literally grew up in this Bay Area independent rap scene."

Known for his affiliation with JT the Bigga Figga’s Get Low Playaz and more recently for his ongoing feud with his cousin rapper Messy Marv, the 30-year-old rapper is a well-established artist. But even a high-profile performer like Quinn accepts that he will be lucky if he sells the 22,000 that his last solo CD, The Rock: Pressure Makes Diamonds (SMC) tracked on SoundScan. That was in 2006, two long digital years ago. As with many veteran rappers, downloaded music has hurt San Quinn. "The majority of my fans are white boys and Latinos and Asians that have that shit mastered," he said. "And it’s even harder for someone like me who is based out of the capitol of technology here in the Bay Area, home of Silicon Valley."

"Since the selling of CDs in stores has gone down, way down, everyone has had to step up their game," Cubano said. Two months before the release of U Don’t Hustle U Don’t Eat, the shrewd rapper will pave the way with the Feet to the Street mixtape in collaboration with Oakland’s Demolition Men, the accurately self-described "Bay Area mixtape kings," whose trusted brand has helped further fuel the careers of such local rap faves as J-Stalin, the Jacka, and Shady Nate. San Quinn and the Jacka, as well as C-BO and Matt Blaque, are among the names the ever-resourceful Cubano has enlisted for his upcoming releases.

"But then there are so many different ways to make money nowadays," Cubano added. "You can get money out of ringtones. You can sell your songs one at a time for $1 a piece on iTunes or from your MySpace even now. I love MySpace. It is great in so many ways, like connecting with artists straight away and not beat around the bush, waiting for a phone call, or waiting for a nightclub to see someone."

MySpace is also San Quinn’s lifeline where, the rapper said, his music’s daily plays are in the thousands. San Quinn generates money beyond CD and digital music sales. "I do ringtones. I do shows. I have a San Quinn skateboard that I put out through FTC," the rapper said. "On our first pressing we just had, I sold a thousand skateboards at $50 a piece and I get $25 off every skateboard."

He also makes a tidy income doing guest appearances or "features" on other artists releases ("They pay me for a verse"). "I’ve done over 3,000 features," he said of the feat that earned him an inclusion in Guinness World Records for the most collaborations with other artists. Landing on television or video game soundtracks can be highly profitable but also highly competitive.

But for an up-and-coming Bay Area hip-hop artist, it is even more challenging to make a buck. On one recent evening on the Pittsburg/Bay Point-to-San Francisco BART train, Macsen Apollo of Oakland’s V.E.R.A. Clique was putting a new spin on the "dirt hustlin’" sales approach pioneered in the 1990s by Hobo Junction and Mystik Journeymen by walking from car to car hawking copies of his hip-hop group’s CD, keeping a watchful eye out for BART police, in an effort to make some money from his music.

Meanwhile back at the City Hall Records offices and warehouse, where Zelnick works on orders for new releases from local rap cats Balance and Thizz artist Duna, things have changed a lot in a decade. "We’re really at a turning point here," he said. "We’re still here and someone is buying music, but I don’t know how much longer." Last week in the UK, with just a few weeks till Christmas, Britain’s key indie label distribution company Pinnacle Entertainment declared bankruptcy, leaving 400 imprints with no way to get their music into the diminishing number of music retail stores.

"Next year I ‘m going to put out Return of the DJ, Vol. 6 and that will be the final physical release I will ever do," said Bomb’s Paul, who believes the only way for rap artists to make money is to be increasingly innovative and to constantly tour and sell merchandise, including music, along the way. "In the very near future I think the only place left to buy a CD is to go a show. Artists have to come up with new ways to generate cash. I heard of some artists who will sell backstage passes for $300 — or whatever they can get."

Cubano concurs. "If you’re sitting around waiting for that call, it ain’t gonna come," he quipped. "You have to get out there. You gotta be in traffic. People have to expand their hustle. Otherwise you don’t eat."

7.5 better ways to balance the budget

OPINION In Mayor Gavin Newsom’s seven-and-a-half-hour YouTube series on the state of our city, he spends barely 30 seconds addressing the budget deficit.

Newsom’s mid-year budget cut plan is completely out of touch with the fundamental priorities of our city. At a time when residents are feeling the impact of the recession in their daily lives, the mayor’s plan guts our public health safety net by slashing programs that serve seniors on fixed incomes and by reducing frontline healthcare workers.

What’s more, the mayor’s mid year cuts leave untouched his bloated senior staff and protects management-heavy departments around City Hall.

So, in response to the effort to balance the budget by slashing tens of millions in health services for the city’s neediest, a coalition of health workers, health providers, and patients are putting forward alternative ways to address the city’s budget problem that are worth our time and thought.

Among the ideas offered by the Coalition to Save Public Health are the following:

1. Start at the top, not at the bottom. Since the mayor first took office, the number of highly paid managers has skyrocketed while the number of employees providing basic city services has stagnated. It’s time to tighten our belt at the management level and eliminate all but the most essential positions that pay more than $100,000 per year.

2. Practice what you preach. In November 2007, the mayor announced a non-essential hiring freeze to deal with the budget crunch. Newsom then promptly spent hundreds of thousands of dollars hiring new senior staff including highly paid and duplicative special assistants for climate control initiatives, "neighborhood empowerment," and a new greening czar. All new staff hired since November 2007 who are paid more than $100,000 should be cut.

3. Cut duplicative programs. The city spends more than $10 million per year on small business outreach and economic development. The Mayor’s Small Business Assistance Center duplicates those services and costs nearly $800,000 every year.

4. Listen to the voters — cut the Community Justice Court. Proposition L was rejected by more than 57 percent of the San Francisco electorate. It’s time to listen to the voters and preserve revenue by cutting current-year funding for the CJC.

5. Save on spin, spend on substance. A recent controller’s report found that the city spent more than $10 million in salaries for public relations and public information staff, including funding for seven people in the Mayor’s Office of Communications last year. The mayor should cut all unnecessary PR staff and reduce his spin operation to two people.

6. Cut the fat, not the bone. Both police and fire unions are due for 7 percent pay increases. As the city cuts salaries or lays off staff across the board, the mayor should work with the board to reopen fire and police contracts.

7. Eliminate unnecessary drivers. For years, the Fire Department’s battalion chiefs have relied on "chief’s aides" to chauffer them around the city. The estimated cost for these positions is more than $2 million.

7.5 Cut in half the city’s contribution to the opera and symphony. In the current year, the city is contributing close to $4 million in General Fund revenue to the operation of the opera, symphony, and ballet. We can’t afford to subsidize organizations with enormous endowments while we slash services for people in need.

I’m not kidding. That’s what the numbers right now suggest. San Francisco over the next year could face a budget deficit of $576 million — almost half of the entire discretionary money that the city has to spend.

Mayor Gavin Newsom, frankly, is entirely missing in action on this one. He’s been hiding out, doing his budget discussions in secret, playing Where’s Waldo (even showing up that the board meeting without a budget plan) and leaving City Hall and thousands of city workers, nonprofits and activists wondering what the hell is going on. The lack of leadership is mind boggling.

In the vacuum, the Coalition to Save Public Health has proposed a series of alternative cuts, and Sup. Aaron Peskin, writing in tomorrow’s Bay Guardian, suggests that the board consider them. The proposals include eliminating unnecessary jobs that pay more than $100,000 a year, cutting back the mayor’s seven-person PR staff, cutting the money the city gives to the Opera and Symphony and re-opening the police and fire contracts. These are all good ideas — and they might, in the best of all circumstances, add up to ten or 20 percent of the deficit.

The reality is that the mayor is going to be making some brutal cuts now — and it will be much worse in a few months, when the supervisors have to deal with the next fiscal year’s budget. You can’t cut half a billion dollars out of San Francisco city government without eliminating a lot of essential programs. Public health? Decimated. Parks and Rec? A wreck. Muni? Service will get way worse, fares may go up, and the city’s commitment to public transit will be at risk. What’s the city do for you? Get ready to give it up.

And you think the job market is bad now and the recession starting to hit the city hard? Imagine when a few thousand city employees join the unemployment lines.

So what are we supposed to do? Let me make a suggestion.

The worst thing a government agency can do in a recession is cut spending. The feds can borrow money and keep spending, but the city can’t. So we simply need to face the fact that this is an emergency, a crisis, the worst situation since the 1930s – and we need to look for new revenue.

We can’t mess around with half steps, either. We need big money, right now – and the best, most fair and progressive way to get that is with an income tax.

Now, the city can’t just impose an income tax on residents, the way New York City and Philadelphia do. The California Constitution pre-empts that. But the city CAN levy a tax on all income earned within the city. So the commuters pay, too (although residents who live here and work somewhere else don’t; it’s an imperfect world). Oakland passed a tax on income earned in the city in the 1970s, and the issue went all the way to the state Supreme Court, which ruled in Weekes v. City of Oakland that the tax was perfectly legal (the City Council dropped the tax anyway). Here’s an opinion on it.

The nice thing about income taxes is that they hit the rich harder than the poor. In fact, San Francisco could exempt, say, the first $100.000 of income, then use a progressive scale to make sure that only well-off people paid anything, and the richest paid the most. Even in a recession, there are rich people in this town, people who have done very well under the Bush tax cuts – and shifting money from the rich to the poor during a recession is excellent economics.

And an income tax could actually bring in enough cash to make a real difference.

Of course, the rich people who pay it can deduct the local tax from their state and federal returns – so a lot of the money actually comes to SF from Washington and Sacramento.

Passing something like this would be a huge political challenge – it would have to go on the ballot, and nobody wants new taxes, and the Chamber of Commerce types would howl and raise huge sums to defeat it. It could only work if the entire City Hall establishment, starting with the mayor, was willing to go out and campaign, hard, for the measure. Make it temporary – the tax would expire in two years. Make it progressive – nobody who is hurting financially would pay a heavy burden. And tell the voters: We tax the rich, or we close libraries, and eliminate Muni lines, and take cops off the streets, and close fire stations, and let sick people die because they can’t see doctors – and watch the local economy fall even deeper into recession as city spending plummets.

Because that’s what we’re talking about here. These are the choices.

There’s a good chance the state will have a special election in the spring – a tax measure could go on the ballot then. Or the city could hold its own special election. And if the city income tax doesn’t fly, I’m open to something – anything – else. But is has to be big, and we have to move on it now.

TV EYED You know a show has gotten under your skin when it begins to trigger nightmares. That’s the case with Showtime’s Dexter, now winding up its third season after building, with frustrating slowness, its intertwined partnership narratives revolving around serial killer-turned-crime fighter Dexter Morgan (Michael C. Hall). Dexter was carefully trained by his adopted hero-cop father to blend in, closet his antisocial blood-thirsty desires, and channel those murderous impulses toward bad apples who slip the scales of justice. Sounds like another "post-racial," pro-assimilation narrative cluttered with Twilight and True Blood vampires looking for acceptance?

As developed from the 2004 novel by Jeff Lindsay, Darkly Dreaming Dexter, the series does wink at the unsavory secret history of superheroes: the difference between, say, Batman and Dexter is that the latter obviously gets off on his kills. Luckily the Miami Metro Police abounds with murderers within and without, although, Dexter, for all his sinister smarts, doesn’t seem to be self-aware enough to realize that his redemptive retraining and repurposing could be applied to the evildoers he so methodically destroys.

The nightmares enter the picture by way of the crack writing and insinuating acting — particularly by Hall, the golden boy with dead eyes, who was also so adept at unpeeling his character’s layers as Six Feet Under‘s dutiful gay conservative, and Jennifer Carpenter, who portrays his impulsive police officer sister, Debra, and rolled her cubist eyes to queasy effect in the title role of 2005’s The Exorcism of Emily Rose. As for Dexter — so busy holding down a job as a blood-spatter forensic specialist at Miami Metro and solving crimes in order to satisfy his blood lust — is there a more untrustworthy narrator on television?

This season centers on Dexter’s continuing trust issues in the form of two partnerships that threaten to rock his world: his upcoming nuptials to damaged but increasingly grounded, pregnant girlfriend Rita (Julie Benz) and his accelerating friendship with Miguel Prado (Jimmy Smits), an ambitious, charismatic assistant district attorney who thinks Dexter has done him the favor of stabbing his brother’s murderer, and seems to understand his needs. Their closeness develops to the point where Dexter mentors Miguel in his first righteous kill, but there’s more to Miguel than meets the eye — leave it to the cutthroat lawyer to really give it his so-called bleeding-heart-liberal public defender nemesis as the series teases out and critiques some of the politically conservative undertones of its quasi-pro-capital-punishment narrative. While the pregnant Rita satisfies her hunger pangs with chocolate at home, it appears that Dexter has created another monster of his own.

A federal court jury in San Francisco has found Chevron not guilty in a case alleging the corporation was complicit in the shootings, killings, and torture of protesters on a Chevron oil platform off the Niger Delta in 1998.

Plaintiffs in the case, who include Larry Bowoto, injured when Nigerian police opened fire on the unarmed protesters, have announced they will appeal the decision to the 9th Circuit, the most liberal appeals courts in the country.

“The fact that Bowoto v. Chevron made it this far in the process is a victory in and of itself, because it means that we have demonstrated that there is a clear pathway in the US court system for holding corporations accountable to the rule of law,” said Laura Livoti, founder of the group Justice in Nigeria Now, in a press release after the verdict. “This is the first time a case against a company for aiding and abetting human rights violations overseas has even gone before a jury.”

The case was filed under the Alien Tort Statute, an 18th century law that allows foreign victims of human rights crimes inflicted by US-based corporations to sue them in US courts, and a ‘guilty’ verdict would have been a first – similar cases settled out of court in the past.

So, this is a victory for Chevron, which has been spending a lot of cash on its image lately and was dealt a losing hand from voters on Election Day with the passage of Measure T, a business tax reform measure that will cost the billion-dollar corporation $26 million. The money will go to Richmond city coffers and Green Party Mayor Gayle McLaughlin has said funds will be allocated for projects through an open public process, according to a story in today’s Chronicle.

REVIEW An attractive 30-something woman with a face hardened by rough times — most recently the 2002 Prague flood pretty much ruining her Prague home — Marcela (Anna Geislerova) is raising two children under precarious circumstances. Marriage to Jarda (Roman Luknar) is discordant, despite their volcanic sex, in large part because she objects to his paying the bills by running a chop shop. She’s already left the with the kids — albeit due to her son’s severe allergy to their digs’ post-flood moldiness — when Jarda steals the wrong guy’s car and gets his whole operation busted by police. With the breadwinner in jail, what’s Marcela to do? Move in with her crazy religious mother in-law (Emilia Vasaryova)? Nope. Stay with her own mother (Jana Brejchova) and the latter’s very creepy diabetic boyfriend (Jiri Schmitzer) in their cramped apartment? Yes, until something better comes along. Which, surprisingly, it does in the form of Czech-Italian vintner Benes (Josef Abrham), whose stolen car triggered Jarda’s arrest. He’s that staple of 1930s screwball comedies so seldom encountered since, in real or cinematic life: the suave older man who’s single, rich, lonely, and genuinely concerned over our underclass heroine’s welfare. This conceit might seem overly contrived in lesser hands than those of director Jan Hrebejk and scenarist Petr Jarchovsky (of prior foreign-language Oscar nominees 2000’s Divided We Fall and 2004’s Up and Down). But their excellently crafted and performed seriocomedy — with its frank yet funny sexual randiness — never feels less than credible. In a classically warm yet ironic, ambitious yet intimate, absurdist yet realistic Czech cinema fashion that Hrebejk and Jarchovsky will hopefully torch-carry well into the 21st century.

REVIEW As a programming move, the Roxie Theater’s decision to screen Rob Epstein’s classic 1984 documentary The Times of Harvey Milk is both a no-brainer and a bit of casual brilliance. It’s a no-brainer because of Milk mania. It’s a little stroke of genius because this great documentary’s return, one week before the theatrical premiere of Gus Van Sant’s feature at the Castro, provides plentiful compare-and-contrast opportunities for all those wise enough to know that they need to see both. This isn’t the first time that the Roxie — which presented Tsai Ming-liang’s homage to movie theaters Goodbye, Dragon Inn during the Castro’s days of turmoil in 2004 — has chimed in like a smart kid brother.

Epstein’s movie is a classic partly because of its historical contents, but there’s a definite mastery to the way in which he assembles and presents that material — if today’s makers of stylized docs haven’t learned from his command, that command has at least influenced Van Sant. The Times of Harvey Milk doesn’t dig into day-to-day San Francisco politics with the same relish or perhaps even specificity of the Van Sant movie (which recalls Barbet Schroeder’s 1990 Reversal of Fortune in its affection for scenes of creative, energetic groupthink). But journeying through candlelight vigil and through riot, it remains the most dramatically powerful response to Harvey Milk. His life and death were the stuff of great drama as well as of history.

The time for The Times of Harvey Milk is now, once again: more than a number connects and separates Proposition 6 of Milk’s era with Proposition 8 today. Thanks to Epstein’s compassionate documentary eye, his talking heads are fully realized human characters, with a range of personalities: the fervor of Tom Ammiano, the gruff candor of union machinist Jim Elliot (who thought the police raids on gay bars were fine until he met Milk), the contemplative sadness and strength of Sally M. Gearhart. Other touches, such as Harvey Fierstein’s uncharacteristically stoic voice-over, are surprising. And Epstein doesn’t glorify or beatify Milk when presenting the relationship between Milk and Dan White — his look at their interactions shows the sharp, competitive edges of Milk’s humanism.

The 2004 anniversary edition of the Times of Harvey Milk DVD is a treasure trove of material providing greater insight into Dan White. But it’s important to revisit this movie outside of the isolated home box office. There are generations of people who, if they’ve seen it, have only seen The Times of Harvey Milk on video at home. Like the man at the core of its subject, Epstein’s documentary thrives in a public, theatrical setting. The events it collects and captures are still relevant to all the random people who will find themselves united by a decision to watch this movie in a cinema — people who will step outside of the Roxie into a city and a world not that different from the one where Harvey Milk died and lived, one that is demanding collective action, and his spirit, once again.

Politics behind the picture

The new Harvey Milk movie, which opens later this month, begins as a love story, a sweet love story about two guys who meet in a subway station and wind up fleeing New York for San Francisco. But after that, the movie gets political — in fact, by Hollywood standards, it’s remarkably political.

The movie raises a lot of issues that are alive and part of San Francisco politics today. The history isn’t perfect (see sidebar), but it is compelling. And while we mourn Milk and watch Milk, we shouldn’t forget what the queer hero stood for.

Milk started out as something of a pot-smoking hippie. “The ’70s were a hotbed of everything,” Sup. Tom Ammiano remembered. “Feminism, civil rights, antiwar.” Milk’s early campaigns grew out of that foment. “Sure, he wanted to be elected,” Ammiano told us. “But the main ingredient was courage. He was fighting with the cops when they raided the bars … what he did was dangerous.”

Milk never would have been elected supervisor without district elections — and the story of district elections, and community power, ran parallel to Milk’s own story, for better and for worse.

Milk tried twice to win a seat on the at-large Board of Supervisors and never made the final cut. But in the mid-1970s, a coalition of community leaders, frustrated that big money controlled city policy, began organizing to change the way supervisors were elected. The shift from an at-large system to a district one in 1976 was a transformational moment for the city.

“I think that San Francisco doesn’t always appreciate the sea change that district elections brought,” Cleve Jones, a queer activist and friend of Milk who helped Dustin Black write the script for Milk, told us. “It wasn’t just important to the various communities that had been locked out of power at City Hall — it was the glue that began to grow the coalitions.”

Milk was elected as part of what became the most diverse board in the city’s history, with Asian, black, and gay representatives who came out of community organizations. The board, of course, also included Dan White, a conservative Irish Catholic and former cop. And it was the assassination of Milk and Mayor George Moscone by Sup. White — and the civic heartbreak, chaos, and confusion that followed — that allowed downtown forces to repeal district elections in 1980. That gave big money and big business control of the board for another 20 years, a reign that ended only when district elections returned in 2000.

Milk was a gay leader, but he was also a tenant activist, public power supporter, advocate for police reform, supporter of commuter taxes on downtown workers, and coalition-builder who helped bring together the labor movement and the queer community. It started, ironically, with the Teamsters.

“Those of us who came out of the antiwar movement remembered that the Teamsters supported Richard Nixon until the very last moment,” Jones said. “And they were seen as one of the most homophobic of all the unions.”

But in the 1970s, the Teamsters were at war with the Coors Brewing Company, and trying to get San Francisco bars to stop serving Coors beer. Allan Baird, a Teamsters leader who lived in the Castro District, saw an opportunity and contacted Milk, who agreed to help — if the Teamsters would start hiring gay truck drivers.

“It wasn’t just San Francisco and California,” Jones recalled. “We got Coors beer out of every gay bar in North America.” And gays started driving beer trucks.

Today, the queer-labor alliance is one of the most powerful, effective, and lasting political forces in San Francisco.

Milk was never popular among the wealthier and more established sectors of the gay community; he believed in a populist brand of politics that wasn’t afraid to take the fight to the streets — and beyond San Francisco. A central theme of the film is the fight against Proposition 6, a 1978 measure by conservative state Sen. John Briggs that would have barred homosexuals from teaching the public schools.

Milk, defying the mainstream political strategists, insisted on debating Briggs in some of the most right-wing parts of the state. He refused to downplay the gay-rights issues. And when Prop. 6 went down, it was the end of that particular homophobic crusade.

Milk was always an outsider, and he ran for office as a foe of the Democratic Party machine. “His campaign for state Assembly was all about Harvey vs. the machine,” former Sup. Harry Britt told us. “His main supporter was [Sup.] Quentin Kopp. He didn’t run as the liberal in the race; he ran against the machine.” And for much of the next 20 years, progressives in San Francisco found themselves fighting what became the Brown-Burton machine, controlled by Willie Brown and John Burton.

It’s too bad the movie wasn’t released early enough to have had an impact on Prop. 8, the anti same-sex marriage measure that just passed in California. Some critics of the No on 8 campaign say the message was far too soft, and that a little Harvey-Milk-style campaigning might have helped.

But for us, one of the most striking things about the movie is the fact that Milk and his lover, Scott Smith, were able to leave New York with very little money, arrive in San Francisco, rent an apartment on their unemployment checks, and open a camera store. That wouldn’t be possible today; the Harvey Milks of 2008 can’t live in the Castro — and many can’t live anywhere in San Francisco. The city is too expensive.

In fact, for all the victories Milk won, for all the successes of the movement he helped to build, much of his agenda is still unfulfilled, even in his hometown.

The first time Harvey Milk gives a public speech in the film, he’s standing on a soapbox … literally. He brings out a box with “soap” written on the side; a funny gag, but a serious and telling moment for him and San Francisco.

The issues that Milk spoke so passionately about in that speech included police reform, ending the war on drugs, protecting tenants and controlling rents, and improving parks and protecting people’s rights to use them liberally — all issues with as much resonance today as they had back then.

The movie leaves us with a painful question. For all the celebration of Milk’s legacy by San Franciscans of various political stripes, why have we made so little progress on some of his signature issues? We celebrate the martyr — but often forget what the man really advocated.

Support for gay rights is de rigueur for anyone who aspires to public office in San Francisco. But a quarter of city residents still voted to take away same-sex marriage rights in this election. Many older gay men today are barely able afford their AIDS medication and rent. And transgender people and other nontraditional types are still ostracized, unable to get good jobs, and sometimes treated contemptuously when they seek help from their government.

Sure, marijuana is supposedly legal for medical uses in California and pot clubs proliferate around San Francisco. But even these sick patients are still targeted by the federal government and its long arms in San Francisco, including former US Attorney Kevin Ryan, whom Mayor Gavin Newsom named his top crime advisor and who is now seeking to crackdown on the pot clubs. Why, 30 years after Milk was shot, does one have to claim an ailment or illness to smoke a joint in this town?

Two-thirds of city residents are renters, a group Milk championed with gusto, but we barely beat a state initiative in June that would have abolished rent control. Housing is getting steadily more expensive. And in this election, Newsom and his downtown allies opposed Proposition B, an affordable housing measure, and Proposition M, a common sense measure to prohibit landlords from harassing their tenants. Such harassment is a common tactic to force tenants from rent-controlled units, even though the City Attorney’s Office is currently suing the city’s biggest landlord, Skyline Realty, for its well-documented history of harassment. Newsom may be the champion of same-sex marriage, but when it comes to issues like tenants’ rights, we suspect that Milk would be appalled at Newsom’s gall.

Ted Gullicksen of the San Francisco Tenants Union noted that in the wake of Milk’s death and before the repeal of district elections, San Francisco established rent control and limits on condo conversions. The tenant movement has grown steadily stronger and more sophisticated, he said, as it had to in order to counter increasing economic and political pressures and creative gambits by landlords.

“The city has gentrified phenomenally since that time, and that’s put tremendous pressure on tenants and on condo conversions,” Gullicksen told us. “It continues to be a real struggle.”

Police reform was also a huge issue for Milk and his gay contemporaries, who suffered more than most groups from the behavior of thuggish cops protected by weak oversight rules and a powerful union. And today, the Police Officers Association is stronger and meaner than ever, but the oversight has improved little, as both the Guardian and San Francisco Chronicle have explored with investigations in recent years.

And in our public parks, San Francisco officials in recent years have banned smoking cigarettes, drinking alcohol, playing amplified music, and even gathering in large numbers without expensive, restrictive permits. Even in the Castro, where Milk and his allies took it as a basic right to gather in the streets, Newsom and the NIMBYs unilaterally cancelled Halloween celebrations and used police to chase away citizens with water trucks.

Is this really the city Harvey Milk was trying to create? In the film, he talks about transforming San Francisco into a vibrant, tolerant beacon that would set an example for the rest of the country, telling his compatriots, “We have got to give them hope.”

Well, with hope now making a comeback, perhaps San Francisco can finally follow Milk’s lead on the issues he cared about most.

Fighting Newsom’s mid-year cuts

EDITORIAL If Mayor Gavin Newsom moves forward aggressively with mid-year cuts to the city budget, a lame duck Board of Supervisors with four veterans — including the board president and chair of the Budget Committee — on their way out the door could be voting on harsh reductions in city spending on health care, parks, and other services. That’s not the best way to make policy; we’d rather the cuts go to the new board, which will be dealing with next year’s budget anyway. But if the mayor is pushing reductions now, the current board needs to act aggressively and quickly to be sure that the mayor’s wrongheaded priorities don’t carry the day.

We recognize that the city has money problems. Like every other taxpayer-financed entity in America, San Francisco is getting hit hard by the recession. When retail sales drop, so do local sales taxes. When real estate values plummet, so do property taxes receipts. And while some prominent economists are urging President-elect Barack Obama to pour federal money into cities this spring, nobody can count on that happening.

City Controller Ben Rosenfield is projecting that the city will be around $100 million short of cash by the end of the fiscal year. And since California cities (unlike the federal government) can’t run a deficit, that money has to come from somewhere. (Fortunately, the red ink won’t be as bad as it might have been — with little help from the mayor, Sup. Aaron Peskin got two new revenue measures passed in November that will bring some $50 million more into city coffers).

Newsom’s chief target at this point is the Department of Public Health, which is facing more than $256 million in cuts. That’s on top of all the cuts the department has had to absorb over the past two years — and it will cut deeply into the city’s ability to maintain its landmark Healthy San Francisco program. The Recreation and Park Department, libraries, and Muni will face cutbacks too, and there’s almost certainly a Muni fare hike (essentially a tax on the poor) on the horizon.

But there’s no talk of reducing or eliminating any of the mayor’s pet programs — like the 311 call center, which is a fine service but perhaps not as important as medical staff at SF General — or cutting significantly into his own office spending.

And, as always, the mayor has failed to look at any additional sources of revenue (with the possible exception of new parking meters in Golden Gate Park and at Marina Green). It’s particularly frustrating that Newsom and his hired gun, Eric Jaye, pushed so hard to help Pacific Gas and Electric Co. defeat the Clean Energy Act when public power would be the source of hundreds of millions in annual revenue. (PG&E killed 10 other ballot measures that would have brought cheap Hetch Hetchy public power to San Francisco, the largest source of potential new revenue for the city, and the private monopoly yanks more than $650 million a year out of the city in high rates, according to a Guardian study.)

The supervisors don’t have to wait for the mayor to propose cuts and then react. They can begin to move now. They can begin to identify their own set of cuts and revenue enhancements — and can begin establishing an alternative set of priorities. Is it better to cut 311 and the mayor’s special global warming deputy than to cut nurses at General? Is it better to close some redundant fire stations than cut hours at libraries? Should parking meters and garage fees go up downtown before city parks get meters? Back in 1973, in his first run for supervisor, Harvey Milk proposed eliminating the police vice squad (see "I remember Harvey"). That’s an idea whose time may have come again.

The point is that the mayor, who is weak and more focused on running for governor than on running the city, shouldn’t be driving the fiscal agenda alone. The supervisors need to either agree that they won’t act on cuts until the new board takes office or offer some alternative plans today.

Toward the end of the supervisorial campaign in 1973, I got an intercom call from Nancy Destefanis, our advertising representative handling political ads. Hey, she said, I got a guy here by the name of Harvey Milk who is running for supervisor and I think you ought to talk to him.

Milk? I replied. How can anybody run for supervisor with the name of Milk?

Nancy laughed and said that wasn’t his big problem, it was that he was running as an openly gay candidate, but he had strong progressive positions and potential. Nancy, a former organizer for Cesar Chavez’ farm workers, was tough and savvy, and I always took her advice seriously. "Send him in," I said.

And so Harvey Milk came into my office, at the start of his political career, looking like a well-meaning amateur. He had a ponytail and mustache, wore Levi’s and a T-shirt, and talked breathlessly about his issues without a word about how he intended to win. His arguments were impressive, but he clearly was not ready for prime time. We gave him our "romantic" endorsement. He got 17,000 votes.

I also advised him, as diplomatically as I could, that if he wanted to be a serious candidate, he needed to clean up his act.

Two years later, Milk strode into the Guardian in a suit and tie as a serious candidate ready to win and lead. As our strong endorsement put it, "Now he’s playing politics for real: he’s shaved his mustache, is running hard in the voting areas of the Sunset, and has picked up a flock of seemingly disparate endorsements from SF Tomorrow, the Building and Trades Council, Teamsters (for his work on the Coors beer boycott) and the National Women’s Caucus." On policy, we said he "would put his business acumen to work dissecting the budget" and "would fight for higher parking taxes, no new downtown garages, a graduated real estate transfer tax, an end to tax exemptions for banks and insurance companies, dropping the vice squad from the police budget, and improved mental health care facilities." He couldn’t get enough votes citywide to win, but he came closer.

In 1976, Milk decided to run for a state Assembly seat against Art Agnos. We decided to go with Agnos, largely because he was familiar with Sacramento as an aide to former assemblyman Leo McCarthy and also because our political reporter covering the race, Jerry Roberts, said that Agnos was much better on Sacramento issues during the campaign. We decided that Agnos was right for Sacramento and that we needed Milk in San Francisco. I have often wondered if we had endorsed Milk, and he had won, if he would still be alive.

The next year, when the city shifted to district supervisorial elections, Milk won and became the first openly gay elected official in the country. He would always say, "I am not a gay supervisor, I am a supervisor who happens to be gay."

On the afternoon of Friday, Nov. 24, 1978, Milk dropped by to see me at the Guardian. He was a bit dejected. Things were getting tougher for him on the board. He was getting hassled by his friends and allies who were telling him, as he put it, "if you don’t vote for me on this one, I’m going to stop supporting you." He said he was going to press on, but from then on he was going to work more closely with the Guardian on legislation and on giving us information.

Then he smiled the famous Harvey Milk smile and said as he left my room, "I want to be your Deep Throat at City Hall."

Those were the last words I ever heard from Harvey Milk. He was assassinated three days later.

The people’s election

By midnight Nov. 4, the drama was long over: John McCain had conceded, Barack Obama had delivered his moving victory speech — declaring that “change has come to America” — and the long national nightmare of the Bush years was officially headed for the history books.

But in San Francisco, the party was just getting started.

Outside of Kilowatt, on 16th Street near Guerrero, the crowd of celebrants was dancing to the sounds of a street drummer. In the Castro District, a huge crowd was cheering and chanting Obama’s name. And on Valencia and 19th streets, a spontaneous outpouring of energy filled the intersection. Two police officers stood by watching, and when a reporter asked one if he was planning to try to shut down the celebration and clear the streets, he smiled. “Not now,” he said. “Not now.”

Then, out of nowhere, the crowd began to sing: O say can you see /By the dawn’s early light …

It was a stunning moment, as dramatic as anything we’ve seen in this city in years. In perhaps the most liberal, counterculture section of the nation’s most liberal, counterculture city, young people by the hundreds were proudly singing The Star Spangled Banner. “For the first time in my life,” one crooner announced, “I feel proud to be an American.”

Take that, Fox News. Take that Sean Hannity and Rush Limbaugh and Sarah Palin and the rest of the right-wing bigots who have tried to claim this country for themselves. On Nov. 4, 2008, progressives showed the world that we’re real Americans, too, proud of a country that has learned from its mistakes and corrected its course.

President Obama will let us down soon enough; he almost has to. The task at hand is so daunting, and our collective hopes are so high, that it’s hard to see how anyone could succeed without a few mistakes. In fact, Obama already admitted he won’t be “a perfect president.” And when you get past the rhetoric and the rock star excitement, he’s taken some pretty conservative positions on many of the big issues, from promoting “clean coal” and nuclear power to escautf8g the war in Afghanistan.

But make no mistake about it: electing Barack Obama was a progressive victory. Although he never followed the entire progressive line in his policy positions, he was, and is, the creature of a strong progressive movement that can rightly claim him as its standard-bearer. He was the candidate backed from the beginning by progressives like Supervisors Chris Daly and Ross Mirkarimi (a Green). And only after his improbable nomination did moderates like Mayor Gavin Newsom and Sen. Dianne Feinstein jump on the bandwagon.

From the start, the young, activist, left wing of the Democratic Party was the driving force behind the Obama revolution. And while he has always talked to the Washington bigwigs — and will populate his administration with many of them — he would never have won without the rest of us. And that’s a fact of political life it will be hard for him to ignore, particularly if we don’t let him forget it.

For a few generations of Americans — everyone who turned 18 after 1964 — this was the first presidential election we’ve been able to get truly excited about. It was also the first presidential election that was won, to a significant extent, on the Internet, where progressive sites like dailykos.com raised millions of dollars, generated a small army of ground troops, and drove turnout in both the primaries and the general election. The movement that was built behind Obama can become a profound and powerful force in American politics.

So this was, by any reasonable measure, the People’s Election. And now it’s the job of the people to keep that hope — and that movement — alive, even when its standard-bearer doesn’t always live up to our dreams.

The evidence that this was the People’s Election wasn’t just at the national level. It showed up in the results of the San Francisco elections as well.

This was the election that would demonstrate, for the first time since the return of district elections, whether a concerted, well-funded downtown campaign could trump a progressive grassroots organizing effort. Sure, in 2000, downtown and then-Mayor Willie Brown had their candidates, and the progressives beat them in nearly every race. But that was a time when the mayor’s popularity was in the tank, and San Franciscans of all political stripes were furious at the corruption in City Hall.

“In 2000, I think a third of the votes that the left got came from Republicans,” GOP consultant Chris Bowman, who was only partially joking, told us on election night.

This time around, with the class of 2000 termed out, a popular mayor in office and poll numbers and conventional wisdom both arguing that San Franciscans weren’t happy with the current Board of Supervisors (particularly with some of its members, most notably Chris Daly), many observers believed that a powerful big-money campaign backing some likable supervisorial candidates (with little political baggage) could dislodge the progressive majority.

As late as the week before the election, polls showed that the three swings districts — 1, 3, and 11 — were too close to call, and that in District 1, Chamber of Commerce executive Sue Lee could be heading for a victory over progressive school board member Eric Mar.

And boy, did downtown try. The big business leaders, through groups including the Committee on Jobs, the Chamber, the Association of Realtors, Plan C, the newly-formed Coalition for Responsible Growth, and the Building Owners and Managers Association, poured more than $630,000 into independent expenditures smearing progressive candidates and promoting the downtown choices. Newsom campaigned with Joe Alioto, Jr. in District 3 and Ahsha Safai in District 11. Television ads sought to link Mar, John Avalos, and David Chiu with Daly.

Although the supervisors have no role in running the schools, the Republicans and downtown pushed hard to use a measure aimed at restoring JROTC to the city’s high schools as a wedge against the progressives in the three swing districts. They also went to great lengths — even misstating the candidates’ positions — to tar Mar, Chiu, and Avalos with supporting the legalization of prostitution.

And it didn’t work.

When the votes were counted election night, it became clear that two of the three progressives — Avalos and Chiu — were headed for decisive victories. And Mar was far enough ahead that it appeared he would emerge on top.

How did that happen? Old-fashioned shoe leather. The three campaigns worked the streets hard, knocking on doors, distributing literature, and phone banking.

“I’ve been feeling pretty confident for a week,” Avalos told us election night, noting his campaign’s strong field operation. As he knocked on doors, Avalos came to understand that downtown’s attacks were ineffective: “No one bought their horseshit.”

A few weeks earlier, he hadn’t been so confident. Avalos said that Safai ran a strong, well-funded campaign and personally knocked on lots of doors in the district. But ultimately, Avalos was the candidate with the deepest roots in the district and the longest history of progressive political activism.

“This is really about our neighborhood,” Avalos told us at his election night party at Club Bottom’s Up in the Excelsior District. “It was the people in this room that really turned it around.”

The San Francisco Labor Council and the tenants’ movement also put dozens of organizers on the ground, stepping up particularly strongly as the seemingly coordinated downtown attacks persisted. “It was, quite literally, money against people, and the people won,” Labor Council director Tim Paulson told us.

Robert Haaland, a staffer with the Service Employees International Union and one of the architects of the campaign, put it more colorfully: “We ran the fucking table,” he told us election night. “It’s amazing — we were up against the biggest downtown blitz since district elections.”

The evidence suggests that this election was no anomaly: the progressive movement has taken firm hold in San Francisco, despite the tendency of the old power-brokers — from Newsom to downtown to both of the city’s corporate-owned daily newspapers — to try to marginalize it.

Political analyst David Latterman of Fall Line Analytics began the Nov. 5 presentation at the San Francisco Planning and Urban Research Association election wrap-up by displaying an ideologically-coded map of San Francisco, drawing off of data from the Progressive Voter Index that he developed with San Francisco State University political science professor Rich de Leon. The PVI is based on how San Francisco residents in different parts of the city vote on bellwether candidates and ballot measures.

“Several of the districts in San Francisco discernibly moved to the left over the last four to eight years,” Latterman told the large crowd, which was made up of many of San Francisco’s top political professionals.

The two supervisorial districts that have moved most strongly toward the progressive column in recent years were Districts 1 (the Richmond) and 11 (the Excelsior), which just happened to be two of the three swing districts (the other being District 3–North Beach and Chinatown) that were to decide the balance of power on the Board of Supervisors this election.

Latterman said Districts “1, 3, and 11 went straight progressive, and that’s just the way it is.”

In fact, in many ways, he said this was a status-quo election, with San Francisco validating the progressive-leaning board. “A lot of people in the city didn’t see it as a chance for a drastic change citywide.”

In other words, keeping progressives in City Hall has become a mainstream choice. Whatever downtown’s propaganda tried to say, most San Franciscans are happy with a district-elected board that has brought the city a living-wage law and moved it a step toward universal health insurance.

The fate of the local ballot measures was another indication that Newsom, popular as he might be, has little ability to convince the voters to accept his policy agenda.

Voters rejected efforts by Newsom to consolidate his power, rejecting his supervisorial candidates, his Community Justice Center (as presented in Measure L), and his proposed takeover of the Transportation Authority (soundly defeating Proposition P) while approving measures he opposed, including Propositions M (protecting tenants from harassment) and T (Daly’s guarantee of substance abuse treatment on demand).

Asked about it at a post-election press conference, Newsom tried to put a positive spin on the night. “Prop. A won, and I spent three years of my life on it,” he said. “Prop B. was defeated. Prop. O, I put on the ballot. I think it’s pretty small when you look at the totality of the ballot.” He pointed out that his two appointees — Carmen Chu in District 4 and Sean Elsbernd in District 7 — won handily but made no mention of his support for losing candidates Lee, Alicia Wang, Alioto, Claudine Cheng, and Safai.

“You’ve chosen two as opposed to the totality,” Newsom said of Props. L and P. “Prop. K needed to be defeated. Prop. B needed to be defeated.”

Yet Newsom personally did as little to defeat those measures as he did to support the measures he tried to claim credit for: Measures A (the General Hospital rebuild bond, which everyone supported) and revenue-producing Measures N, O, and Q. In fact, many labor and progressives leaders privately grumbled about Newsom’s absence during the campaign.

Prop. K, which would have decriminalized prostitution, was placed on the ballot by a libertarian-led signature gathering effort, not by the progressive movement. And Prop. B, the affordable housing set-aside measure sponsored by Daly, was only narrowly defeated — after a last-minute attack funded by the landlords.

All three revenue-producing measures won by wide margins. Prop. Q, the payroll tax measure, passed by one of the widest margins — 67-33.

Latterman and Alex Clemens, owner of Barbary Coast Consulting and the SF Usual Suspects Web site, were asked whether downtown might seek to repeal district elections, and both said it didn’t really matter because people seem to support the system. “I can’t imagine, short of a tragedy, district elections going anywhere,” Latterman said.

Clemens said that while downtown’s polling showed that people largely disapprove of the Board of Supervisors — just as they do most legislative bodies — people generally like their district supervisor (a reality supported by the fact that all the incumbents were reelected by sizable margins).

“It ain’t a Board of Supervisors, it is 11 supervisors,” Clemens said, noting how informed and sophisticated the San Francisco electorate is compared to many other cities. “When you try to do a broad-based attack, you frequently end up on the wrong end (of the election outcome).”

We had a bittersweet feeling watching the scene in the Castro on election night. While thousands swarmed into the streets to celebrate Obama’s election, there was no avoiding the fact that the civil-rights movement that has such deep roots in that neighborhood was facing a serious setback.

The Castro was where the late Sup. Harvey Milk started his ground-breaking campaign to stop the anti-gay Briggs Initiative in 1978. Defying the advice of the leaders of the Democratic Party, Milk took on Briggs directly, debating him all over the state and arguing against the measure that would have barred gay and lesbian people from teaching in California’s public schools.

The defeat of the Briggs Initiative was a turning point for the queer movement — and the defeat of Prop. 8, which seeks to outlaw same-sex marriage, should have been another. Just as California was the most epic battle in a nationwide campaign by right-wing bigots 30 years ago, anti-gay marriage measures have been on the ballot all over America. And if California could have rejected that tide, it might have taken the wind out of the effort.

But that wasn’t to be. Although pre-election polls showed Prop. 8 narrowly losing, it was clear by the end of election night that it was headed for victory.

Part of the reason: two religious groups, the Catholics and the Mormons, raised and spent some $25 million to pass the measure. Church-based groups mobilized a reported 100,000 grassroots volunteers to knock on doors throughout California. Yes on 8 volunteers were as visible in cities throughout California as the No on 8 volunteers were on the streets of San Francisco, presenting a popular front that the No on 8 campaign’s $35 million in spending just couldn’t counter — particularly with so many progressive activists, who otherwise would have been walking precincts to defeat Prop. 8, fanned out across the country campaigning for Obama.

“While we knew the odds for success were not with us, we believed Californians could be the first in the nation to defeat the injustice of discriminatory measures like Proposition 8,” a statement on the No on Prop. 8 Web site said. “And while victory is not ours this day, we know that because of the work done here, freedom, fairness, and equality will be ours someday. Just look at how far we have come in a few decades.”

San Francisco City Attorney Dennis Herrera, joined by Los Angeles City Attorney Rocky Delgadillo and Santa Clara County Counsel Ann C. Raven, filed a legal challenge to Prop. 8, arguing that a ballot initiative can’t be used to take away fundamental constitutional rights.

“Such a sweeping redefinition of equal protection would require a constitutional revision rather than a mere amendment,” the petition argued.

“The issue before the court today is of far greater consequence than marriage equality alone,” Herrera said. “Equal protection of the laws is not merely the cornerstone of the California Constitution, it is what separates constitutional democracy from mob rule tyranny. If allowed to stand, Prop. 8 so devastates the principle of equal protection that it endangers the fundamental rights of any potential electoral minority — even for protected classes based on race, religion, national origin, and gender.”

That may succeed. In fact, the state Supreme Court made quite clear in its analysis legalizing same-sex marriage that this was a matter of fundamental rights: “Although defendants maintain that this court has an obligation to defer to the statutory definition of marriage contained in [state law] because that statute — having been adopted through the initiative process — represents the expression of the ‘people’s will,’ this argument fails to take into account the very basic point that the provisions of the California Constitution itself constitute the ultimate expression of the people’s will, and that the fundamental rights embodied within that Constitution for the protection of all persons represent restraints that the people themselves have imposed upon the statutory enactments that may be adopted either by their elected representatives or by the voters through the initiative process.

As the United States Supreme Court explained in West Virginia State Board of Education vs. Barnette (1943) 319 U.S. 624, 638: ‘The very purpose of a Bill of Rights was to withdraw certain subjects from the vicissitudes of political controversy, to place them beyond the reach of majorities and officials and to establish them as legal principles to be applied by the courts. One’s right to life, liberty, and property, to free speech, a free press, freedom of worship and assembly, and other fundamental rights may not be submitted to vote; they depend on the outcome of no elections.'”

As Board of Supervisors President Aaron Peskin told the Guardian later that week: “Luckily, we have an independent judiciary, because the voters of California have mistakenly taken away a class of civil rights.”

But if that legal case fails, this will probably wind up on the state ballot again. And the next campaign will have to be different.

There already have been many discussions about what the No on 8 campaign did wrong and right, but it’s clear that the queer movement needs to reach out to African Americans, particularly black churches. African Americans voted heavily in favor of Prop. 8, and ministers in many congregations preached in favor of the measure.

But there are plenty of black religious leaders who took the other side. In San Francisco the Rev. Amos Brown, who leads the Third Baptist Church, one of the city’s largest African American congregations, spoke powerfully from the pulpit about the connections between the civil rights struggles of the 1960s and the fight for same-sex marriage.

The next time this is on the ballot, progressive and queer leaders will need to build a more broad-based movement. That is not only possible, but almost inevitable.

The good news — and it’s very good news — is that (as Newsom famously proclaimed) same-sex marriage is coming, whether opponents like it or not. That’s because the demographics can’t be denied: the vast majority of voters under 30 support same-sex marriage. This train is going in only one direction, and the last remaining issue is how, and when, to make the next political move.

The progressives didn’t win everything in San Francisco. Proposition H, the Clean Energy Act, was taken down by one of the most high-priced and misleading campaigns in the city’s history. Pacific Gas and Electric Co. spent more than $10 million telling lies about Prop. H, and with the daily newspapers virtually ignoring the measure and never challenging the utility’s claims, the measure went down.

“This was a big, big, big money race,” Latterman said. “In San Francisco, you spend $10 million and you’re going to beat just about anything.”

But activists aren’t giving up on pushing the city in the direction of more renewable energy (see Editorial).

Latterman said the narrow passage of Prop. V, which asked the school board to consider reinstating JROTC, wasn’t really a victory. “I would not call this a mandate. I worked with the campaign, and they weren’t looking for 53 percent. They were looking for 60-plus percent,” Latterman said. “I think you’ll see this issue just go away.”

Neither Latterman nor Clemens would speculate on who the next president of the Board of Supervisors will be, noting that there are just too many variables and options, including the possibility that a newly elected supervisor could seek that position.

At this point the obvious front-runner is Ross Mirkarimi, who not only won re-election but received more votes than any other candidate in any district. Based on results at press time, more than 23,000 people voted for Mirkarimi; Sean Elsbernd, who also had two opponents, received only about 19,000.

Mirkarimi worked hard to get Avalos, Chiu, and Mar elected, sending his own volunteers off to those districts. And with four new progressives elected to the board, joining Mirkarimi and veteran progressive Chris Daly, the progressives ought to retain the top job.

Daly tells us he won’t be a candidate — but he and Mirkarimi are not exactly close, and Daly will probably back someone else — possibly one of the newly elected supervisors.

“It’s going to be the most fascinating election that none of us will participate in,” Clemens said.

The danger, of course, is that the progressives will be unable to agree on a candidate — and a more moderate supervisor will wind up controlling committee appointments and the board agenda.

One of the most important elements of this election — and one that isn’t being discussed much — is the passage of three revenue-generating measures. Voters easily approved a higher real-estate transfer tax and a measure that closed a loophole allowing law firms and other partnerships to avoid the payroll tax. Progressives have tried to raise the transfer tax several times in the past, and have lost hard-fought campaigns.

That may mean that the anti-tax sentiment in the city has been eclipsed by the reality of the city’s devastating budget problems. And while Newsom didn’t do much to push the new tax measures, they will make his life much easier: the cuts the city will face won’t be as deep thanks to the additional $50 million or so in revenue.

It will still be a tough year for the new board. The mayor will push for cuts that the unions who supported the newly elected progressives will resist. A pivotal battle over the city’s future — the eastern neighborhoods rezoning plan — will come before the new board in the spring, when the recent arrivals will barely have had time to move into their offices.

Obama, of course, will face an even tougher spring. But progressives can at least face the future knowing that not only could it have been a lot worse; for once things might be about to get much better.

The Mission District was jubilant tonight, with champagne-wielding, Obama-cheering groups of celebrants roaming the streets and woo-hooing at the constantly honking cars and jingling bikes, and then finally gathering by the hundreds at the intersection of 19th and Valencia shortly after 10 p.m., where they remained for at least an hour, dancing, soaking in the moment, unmolested by police that were nowhere to be found. It was a spontaneous celebration of a historic moment by citizens of the country’s most progressive city.

CHEAP EATS Me and Boink at the counter, aprons on, hands washed, ready to go … "I’ve been looking forward to this all week," I said. "You’re my new favorite person to cook with."

He looked up from his step stool with all the earnestness in the world, which seems to be his for the asking, and asked, "Do you love me?"

"I do, Boink," I said. And I kissed him on the head. "I love you very much."

He said he loved me too, and asked if he could kiss me. (So polite!) I said that he could, and he gave me a cute little peck on the cheek.

You were expecting what? Diarrhea? Well, I did get sick again. The thing about working with kids is that you wind up with every communicable disease in the world, on a daily basis, especially if you kiss them and eat food right out of their mouths, like I do. Gotta stop that. I’m getting sick of being sick.

On the other hand: I, your chicken farmer truly, bought a new (as in new new) car. Thanks to Boink, and Popeye the Sailor Baby, and Big Chunk and Little Chunk de la Cooter, and all their various and sundry parents, I can now afford to make me a monthly payment or two, or 60. And, yes, for the first time in my farmerly life, I am the proud driver of an actually reliable motor vehicle.

All the gears work and everything! Horn … Check this out: it has seatbelts that actually lock when you get in an accident. And, most meaningfully to me, what with winter coming, you don’t have to pop the hood and leave the vehicle to turn the headlights on!

How stylin’ am I?

I know what you’re thinking. You’re going to miss my little tales of sitting on the side of the road for exactly 52 minutes, waiting for my old pickup truck to start, aren’t you? I know I’m going to miss all the colorful people one meets in such a manner. Tow-truck drivers, police, drive-by mechanics, and so forth. Yesterday, out of habit, or nostalgia, or both, I stopped at my local car parts store. I bought a roll of paper towels.

My new pickup, which I named Alice Shaw after my hero, Alice Shaw, is the ever-popular Honda Fit pickup truck. Light blue, almost silvery. It’s so beautiful I cold lick it, and often do.

Now I’m not a car reviewer, I know, but this Fit is the damnedest thing on four wheels. A miracle of modern engineering, it’s the first car ever to be twice as big inside as out. Even more cargo capacity than my old Chevy Sprint! You can carry two bales of straw at once, and still have room prolly for a sack o’ feed and a little load of scrap wood.

First thing I did, before I even drove it off the lot, I folded the back seats down. "Pickup truck mode," I said to the dealer, who nodded unknowingly and handed me my balloons, for the kids.

Then I drove around town looking for Dumpsters, playing with all the buttons, and just generally showing off.

"Wait till you put your first ding in it!" all my friends keep saying.

I don’t know what they’re talking about. I dinged the dang thing at the dealership, I was so nervous. I’ve never been in debt before, not even a credit card debt. Are you kidding me? I had to scratch the driver’s door with my key just to get myself to sign my name.

The idea here, so you know, is to teach myself that I can have and might even deserve something nice in this world. Because I didn’t grow up knowing that. You get so used to can’t have that you forget how to even want. I thought of this a lot, last few months, dating married men, creepy redneck couples, and other unloveables.

My new blue beautiful car = can have.

And I tell you this now so I can say I told you so when you see me, one day, walking around the world with a loving, shiny, and reliable man. With a ding in one cheek.

I’m going to Moby Dick for a drink.”

“He’s kinda like Barack Obama, you know? It’s change we need.”

That’s what Eric Mar organizer Shaw-San Liu said to me when I asked her what sets Mar apart from the other candidates.

“He’s not a career politician, he’s not paid for by special interests,” added Linshao Chin.

The two of them were sitting on a couch at Mar’s headquarters on Geary, slumped with exhaustion after a long day. Around them, supporters huddled around a laptop to check the national poll numbers.

“Obama is our president!” they shouted simultaneously.

Now we’ve moved to China Bistro a few blocks away where Mar’s after party is being held. We still don’t know if he won. A few volunteers — the unlucky ones who aren’t noshing on egg rolls and chow mein — are running over to the police station and firehouse to check their polling numbers.

Update: The local precincts are reporting Mar up to 30% (9:11 pm)

The Chron’s supervisors

Interesting endorsements from the Chron.. I’m not surprised they gave Ross Mirkarimi the nod in D5; he has no real competition, and has done a great job in office from almost any perspective. But the nice words

he’s shown an ability to find common ground on many issues – and has pushed the mayor for more police foot patrols, authored a crackdown on rogue pot clubs and led efforts to ban plastic bags.

fit in with the Chron’s obvious bias in this election. Although Mirkarimi can push the political edge as well as anyone on the board (jeez, did the Chron even support the plastic-bag ban?), the daily paper lauds him for “an ability to find common ground.”

That seems to be why the Chron, which is typically in lock step with downtown’s agenda on local issues, chose Mark Sanchez, another Green, in D9. Sanchez, the paper says, has

proved to be a reasonable consensus builder as president of the Board of Education, and he’s promised to make civility and compromise a priority as supervisor.

I think civility is the word he used with us, and it’s a fine one (actually, I think all three of the D9 progressives can claim they’ll bring civility to the board). But what the Chron wants is “compromise,” which is a buzz word for getting along with, and not defying, the mayor.

It’s not exactly what I think of when I think of Sanchez, who as a progressive on the school board fought bitterly with Arlene Ackerman when she was school superintendent. And in fact, I just called Sanchez and he told me that “I didn’t use the word compromise.” But he did point out that he has a good relationship with the mayor on education issues, and that glimmer of hope was apparently enough for the Chron.

In D 11, the endorsement of Ahsha Safai comes as no surprise, but it’s a bit warped. The district, the Chron says,

needs an active leader who can work with other supervisors and City Hall figures.

(Who do you suppose those “other City Hall figures might be?)

The problem is that Safai has no real political experience and isn’t going to get along at all with the progressives on the board. He won’t even talk to us.

And in D3, Denise McCarthy gets the nod because

In facing a worsening city budget, she’s willing to consider the tough options of budget cuts and layoffs. Though her policy position put her on the left of the spectrum, she is open to other viewpoints and groups in this fractious corner of the city.

You see a pattern here?

The Chron wants people who will avoid fights and all play nicely with Newsom. That’s not what the legislative branch of government is supposed to do, particularly with a mayor who is so focused on running for governor that he isn’t spending much time running the city.

I’m not sure Sanchez is really going to be as willing to compromise as Chron seem to think… but then, I’m not sure the Chron endorsement means that much in D9.

It’s not the invisible hand of Adam Smith tossing hate mail on your doorstep this fall like ugly confetti. It isn’t a distinct and independent group of candidates and civic organizations that just happen to be saying the same things, either. There is a carefully orchestrated campaign going on to undermine the progressive agenda, block affordable housing and clean energy, and give Mayor Gavin Newsom a majority on the Board of Supervisors.

It’s well funded; it’s serious; it’s based on lies — and it’s a threat to rent control, sustainable environmental policies, universal health care, the city’s living wage law, and the rest of the accomplishments and goals of the progressive majority on the board.

If that sounds overblown, listen to what the organizers of this campaign are saying themselves.

On Aug. 15, after progressives took control of the Democratic County Central Committee and installed Sup. Aaron Peskin as chair, John Keogan, the head of a year-old organization called the San Francisco Coalition for Responsible Growth, a pro-downtown group founded to counter the progressive movement, announced his intentions in a letter to allies.

"CRG are [sic] preparing for an all-out attack with other like-minded groups and now is our time to stand-up [sic] and be counted," Keogan wrote. He asked members to support "taking SF on a sharp turn to the right."

Those "other like-minded groups," according to campaign finance reports, are a Who’s Who list of downtown-based organizations that have consistently fought to roll back tenant protections and slash government spending on social services: the Building Owners and Managers Association, the Committee on Jobs, Pacific Gas and Electric Co., the Association of Realtors, the Chamber of Commerce, Plan C, and the Police Officers Association.

By law, political candidates can only raise and spend limited amounts of money. But organizations like BOMA, the Realtors, and Plan C can put as much cash as they want into supporting and opposing candidates — as long as the efforts are "independent."

But the orchestration of the attacks on supervisorial candidates Eric Mar, John Avalos, and David Chiu, and the support for their conservative rivals, Sue Lee, Ahsha Safai, and Joe Alioto, is so sophisticated it’s impossible to believe that these groups and candidates aren’t working together.

Between Sept. 9 and Oct. 20, public records show, the groups spent a combined $363,754 ($178,177 in District 1, $104,308 in D3, and $81,269 in D11) on independent expenditures attacking Avalos, Mar, and Chiu and supporting their opponents. They also spent $20,000 supporting Eva Royale in her long shot race for the solidly progressive District 9 seat.

The landlords and downtown aren’t the only ones organizing. All that spending, and the threat of even more to come considering the hundreds of thousands of dollars these downtown groups still have in the bank, has served to unite tenant and labor groups in ways unseen in previous San Francisco elections.

"There’s an unprecedented coalition between tenants and labor," labor activist Robert Haaland told us. "We’re working together to defeat the landlord candidates, who are also anti-labor."

"We have a tremendous fear that the spending and progress on health care and social services will be rolled back," Tim Paulson, president of the San Francisco Labor Council, told us. "Anything less than our candidates [being elected in each of the three swing districts] will pose a real danger to the movement."

NEWSOM’S SLATE


One of the central players in this attempt to take the city away from the progressives and hand it over to downtown is Mayor Gavin Newsom, who is actively supporting Alioto, Lee, and Safai.

Eric Jaye, the mayor’s chief political advisor, has no formal role in the three district campaigns, but Newsom rarely makes a move in local politics without consulting Jaye. In fact, when reporters call the mayor’s press office to ask for comments on local candidates and initiatives, they are typically referred to the private consultant.

Jaye told us he’s talked to all of Newsom’s candidates. "I told them to run on district issues," he said.

The mayor and the latest member of the Alioto clan to seek office (Joe’s sister, Michela, is already on the board) have walked precincts together. And Newsom is so involved with the downtown effort he’s skipping a major Democratic Party gala (where he was slated to get an award) to spend time instead with the Republican-led Coalition for Responsible Growth (CRG).

Jaye’s main job this fall is running the PG&E campaign against the Clean Energy Act, Proposition H. So far PG&E has spent more than $10 million on the effort, and that number will grow in the final week before the election. Part of that same campaign has been propping up Newsom ally Carmen Chu, who has benefited from thousands of dollars of PG&E spending on her race. Chu’s face is all over PG&E’s No on H fliers.

Another central operator is Alex Tourk, the former Newsom aide who resigned after learning that the mayor had been sexually involved with Tourk’s wife. Tourk is now running the CRG operation.

"They brought me on board to do a volunteer campaign that, yes, they funded, but which seeks to inform voters in a non-partisan fashion where the candidates in D1, 3, and 11 stand on key issues," he said.

That campaign’s goal was to get 10,000 people to mobilize — he called them, using a term popularized by Richard Nixon, the "silent majority."

Tourk maintains that door-hangers the group has been distributing don’t endorse any candidates or push any initiatives. But the messages fit exactly with the overall downtown strategy — they seek to discredit the progressives by linking them with controversial ballot measures such as Proposition V, which would urge the School Board to save the military recruitment program, JROTC.

The supervisors have nothing to do with JROTC, but downtown and the Republican Party are using it as a wedge issue.

CRG is facing some political heat of its own: SF Weekly reported in its Oct. 22 issue that CRG’s recently elected president, engineer Rodrigo Santos, accepted money for professional work from someone who had business before the Building Inspection Commission while he served as commission president. Santos is a Republican, like several key Newsom appointees.

Making matters worse are revelations that Mel Murphy, vice president of the inspection commission and a CRG member, distributed invites in City Hall to an Oct. 17 CRG fundraiser for Safai and Alioto. City officials aren’t supposed to do political work at City Hall.

Alioto’s filings show that on Oct. 17, he received $500 from the firm of Santos and Urrutia’s structural engineer Kelton Finney and $250 from S&U engineer Calvin Hom.

PG&E’S FAKE DEMOCRATIC CLUBS


Political consultants Tom Hsieh Jr. and Jim Ross are involved in the District 1 race (Hsieh also responded to the Guardian on Safai’s behalf) — and are using PG&E and downtown money to support Sue Lee.

Beyond Chron reported Oct. 27 that Hsieh has been sending robocalls in Cantonese to voters saying that Lee is endorsed by the "San Francisco Democratic Party Club." Actually, the Democratic Party endorsed Mar.

What is this new "party club" anyway? Well, the Web site reported, the club started raising money just two weeks ago, and already has collected $30,000 from PG&E, $2,000 from the Chamber of Commerce, $5,000 from GGRA (Golden Gate Restaurant Association), and $70,000 from the Committee on Jobs. Another new club, called the Richmond Reform Democratic Club, is opposing Mar — and has $18,000 from the Committee on Jobs, $5,000 from PG&E, and $2,000 from BOMA.

In television ads paid for by the Realtors, a voiceover tries to link Mar, Avalos, and Chiu to Sup. Chris Daly, whose popularity outside his district is low — although neither Mar nor Chiu has much of a discernable connection to Daly. Avalos was a Daly City Hall aide.

One of the Realtors ads was so utterly inaccurate and deceptive — it claimed Chiu and Avalos support decriminalizing prostitution, when both have publicly opposed the decriminalization ballot measure — that Comcast pulled the ad off the air when Chiu filed a complaint.

Fog City Journal uncovered what appears to be illegal collusion between the police union and Safai. Although candidates are barred from coordinating with groups making independent expenditures on their behalf, POA president Gary Delagnes told FCJ editor Luke Thomas that Safai had given the group a photo of him to use on a mailer, a copyrighted image that Thomas took. Safai denied wrongdoing, but refused to answer further inquiries about the matter.

It’s a pitched battle — labor, the tenants, and the Democratic Party against the landlords, PG&E, downtown interests, and the Republicans. It’s pretty clear which side you want to be on.

Family act

District 3 supervisorial candidate Joe Alioto Jr., 36, has stated repeatedly on the campaign trail that he is not running on his family’s name.

But his lack of policy or political experience, combined with his campaign’s close ties to his sister, District 2 Sup. Michela Alioto-Pier — the most conservative and reactionary member of the Board of Supervisors — has progressives fearing he’ll be even more hostile to their values than his sister if he is elected this fall.

Records show that Alioto-Pier, 40, who was appointed by Mayor Gavin Newsom in 2004, consistently votes against the interests of tenants, workers and low-income folks. She recently sponsored legislation that passes increased water and sewer rates along to tenants. In the past, she has voted against relocation money for no-fault evictions and against limits on condominium conversions. And that’s just her record on tenants’ rights.

"Michela makes Sup. Sean Elsbernd look like a progressive," said Board President Aaron Peskin, who is termed out as D3 supervisor and has endorsed David Chiu as his preferred candidate to represent this diverse district, which encompasses Chinatown, North Beach, Fisherman’s Wharf and Telegraph Hill.

Alioto, who bought a $1.3 million Telegraph Hill condominium in 2004, has said in debates that he was proud to serve on the Telegraph Hill Dwellers Board for three years, citing his alleged involvement in stopping the Mills Corporation’s development at Piers 27 and 31, improving the Broadway corridor, and working on neighborhood parks.

But a former THD Board member says Alioto’s claims are wildly overstated.

"He did not achieve anything in North Beach as a board member," our source said. "His attendance was poor, he lacked leadership, and when he was asked to head a Broadway corridor subcommittee to tackle the Saturday night issue, he said no, he was too busy. He was on the opposite side of all our policies and goals. There were even questions whether he was residing in the district, when he house-sat for his parents in the East Bay."

In a March 2006 e-mail to THD members, Alioto acknowledges that he and his wife had indeed been house-sitting in the East Bay for months while his parents were in Italy. "Of course, I have never intended to stay in the East Bay, my being there for simply a temporary period," Alioto wrote, referring to the Supreme Court’s definition of residency, which he said he "relied on to continue to contribute to THD activities."

THD board members aren’t the only ones accusing Alioto of stretching the truth.

The Sierra Club’s John Rizzo is irate over the use of the club’s name in a recent Alioto campaign mailer in which Alioto claims that he helped create the San Francisco Climate Challenge "in collaboration with the Sierra Club and DF Environment."

"What he says is highly misleading," Rizzo told the Guardian. "It makes it sound like an ongoing effort he cofounded with the Sierra Club, but it was a one-time effort that, while worthwhile, only lasted a month and is over and done with."

Rizzo further noted that Alioto did not complete or return the Sierra Club’s candidate questionnaire, as is requested of candidates seeking the club’s political endorsement. Alioto also has ruffled feathers by claiming that he prosecuted criminal cases while working in the Alameda County District Attorney’s office in 1999.

Alameda County Senior Deputy District Attorney Kevin Dunleavy told the Guardian that Alioto was, in fact, "a summer intern, a student law clerk working under supervision" in 1999. "He got to prosecute a few cases under our supervision, including a misdemeanor jury trial, but he never worked as an actual deputy DA," Dunleavy said.

But Alioto’s alleged distortions have tenants’ rights advocates like Ted Gullicksen of the San Francisco Tenants Union wondering if Alioto will preserve rent control and try to abolish the Ellis Act, as he has promised on the campaign trail. Alioto never completed a Tenants Union candidate endorsement questionnaire, and has a massive amount of financial backing from the same downtown real estate and business interests that support his anti-tenant sister, Alioto-Pier.

Campaign disclosures show that Alioto’s campaign consultant, Stephanie Roumeliotes, led the Committee to Reelect Michela Alioto-Pier in 2006. Roumeliotes is also working on two other political campaigns this fall: No on B, which opposes the affordable housing set-aside, and Yes on P, which supports giving Mayor Newsom even greater control of how transportation funds are allocated and spent, and which even Alioto-Pier joined the Board of Supervisors in unanimously opposing.

Public records show that the Alioto siblings have 160 of the same campaign contributors. These include Gap founder Donald Fisher, wealthy socialite Dede Wilsey, and Nathan Nayman, former executive director of the Committee on Jobs, a downtown political action committee funneling big money into preferred candidates like Alioto.

All of which has progressives worrying that Alioto and his sister could become the Donny and Marie Osmond tag team for the same Republican downtown interests that are seeking to overturn the city’s universal health care and municipal identity card programs.

Talking by phone last week after months of stonewalling the Guardian’s requests for an interview, Alioto told us that he admires his sister very much, but that does not mean he shares her beliefs. "She has been through more in her relatively short life than most of us, and she does a great job representing her district," Alioto said. "But we are not the same people. Just because we are siblings does not mean we think the same."

Noting that, unlike his sister, he supports Proposition M, (which would protect tenants from landlord harassment), Alioto said, "If Michela ever proposed legislation that I thought was bad for the district and city, I’d vote against it."

Asked why he opposes the affordable housing measure Prop. B, Alioto told us that he doesn’t think that "locking away any more of our money helps … but I support affordable housing for low-income folks, including rental units, and we need more middle-income housing for police officers, firefighters, nurses and teachers."

As for his endorsement by the rabidly anti-rent control SF Small Property Owners, Alioto said, "I think people are supporting me because I’d be fair and reasonable."

Alioto, who attended Boalt Hall School of Law at UC Berkeley and works as an antitrust lawyer at the Alioto Law Firm with brother-in-law Tom Pier, insists that he never claimed he’d been a deputy DA, "but I have a proven record of being interested in putting criminals behind bars."

Noting that he supports the property tax measures on the ballot, "notwithstanding the fact that some real estate interests supporting my campaign are opposed," Alioto further claimed that estimates that a third of his campaign money is from real estate interests are "severely overblown."

"I think they must have been including architects," he told us.

Asked about the Golden Gate Restaurant Association’s lawsuit against the city’s universal health care ordinance, Alioto said he supports Healthy San Francisco, "but I am concerned a little about putting the burden on small business."

Claiming that he supports the mayor’s community justice center as well as "funding for whatever programs it diverts people to," Alioto talked about kick-starting the economy in blighted areas by creating jobs and incentives for small businesses in those districts. Alioto, who just saw the San Francisco Small Business Advocates kick down $9,500 in support of his campaign, also said he wants to increase the number of entertainment permits, add a movie theater, and decrease parking fees in Chinatown.

"And I support the [Chinatown] night markets," Alioto said, referring to a pet project of Pius Lee, whose Chinatown neighborhood association was found, during a 2006 audit instigated by Peskin, to have received excess city funds and allowed unlicensed merchants to participate in the markets.

But Lee is evidently now in good standing with Alioto and Mayor Gavin Newsom, since he accompanied both on a recent walkabout to boost Alioto’s standing with Chinatown merchants. And Alioto’s election is apparently very important to Newsom, given that the first public appearance the mayor made after returning from his African honeymoon was on behalf of Alioto’s campaign.

All of which seems to confirm progressives’ worst fears that Alioto, just like his sister before him, will become yet another Newsom call-up vote on the board. Three ethics complaints were filed against the Alioto campaign this week, and his detractors say he has a long history of questionable behavior, going back to 1996 when he had a severe ethical lapse while working on his sister’s campaign for Congress.

According to a July 27, 1996 Chronicle article, Alioto, who was then his sister’s campaign adviser, and their cousin, college student Steve Cannata, admitted they conspired to intercept the campaign material of Michela’s congressional opponent, Frank Riggs.

"If Miss Alioto tolerates this sort of deceit in her campaign, it is frightening to imagine how she would behave if ever elected," Riggs wrote at the time. Alioto-Pier lost that race. But if her brother wins this November, can progressives help but be a little frightened to imagine just how the Alioto siblings might behave?

As one observer who preferred to remain anonymous told us, "Alioto may be all Joe Personality on the campaign trail, and have the same photogenic smile as his sister, but in reality, he is a fraud."

The stealth candidate

Ahsha Safai is hoping to be elected to the Board of Supervisors without answering questions about his padded political resume of short-lived patronage jobs, greatly exaggerated claims of his accomplishments, history as a predatory real estate speculator, connections to and coordination with downtown power brokers, shifting and contradictory policy positions, or the many other distortions this political neophyte is offering up to voters in District 11, a crucial swing district that could decide the balance of power in city government.

Safai has refused numerous requests for interviews with the Guardian over the last two months. We’ve even left messages with specific concerns about his record and positions. But our investigation reveals his close political ties to the downtown interest groups that have spent close to $100,000 on his behalf and shows him to be a shameless opportunist who is apparently willing to say anything to achieve power.

There’s much we don’t know about Ahsha Safai, but there’s enough we do know for a consistent yet troubling portrait to emerge.

Safai moved to San Francisco from Washington, DC with his lawyer wife in 2000, and immediately began to ingratiate himself into the mainstream Democratic Party power structure, starting as a legislative liaison with the corruption-plagued San Francisco Housing Authority and joining Gavin Newsom’s mayoral campaign in 2003.

Safai became a protégé of Newsom’s field director Alex Tourk, who was a top Newsom strategist for several years until he abruptly resigned after learning that Newsom had an affair with his wife. With support from Tourk (who didn’t respond to our calls about Safai) and Newsom, Safai held a string of city jobs over the next three years, moving from the Mayor’s Office of Community Development to the Mayor’s Office of Neighborhood Services to the Department of Public Works, all of which he touts on his Web ite, greatly exaggerating (and in some cases, outright misrepresenting) his accomplishments in each, according to those who worked with him. (Few sources who worked with Safai would speak on the record, fearing repercussions from Newsom).

THE CONNECT DISASTER


One project Safai doesn’t mention on his Web site is his work spearheading Community Connect, the most disastrous of Newsom’s SF Connect programs. "It’s the one Connect that the mayor will never talk about," said Quentin Mecke, who participated in the effort, on behalf of nonprofit groups, to create a community policing system. "The whole thing just devolved into chaos and there weren’t any more meetings."

In 2005, Safai and Tourk convened meetings in each of the city’s police precincts to take testimony on rising violence and the failure of the San Francisco Police Department to deal with it. Ultimately Newsom decided to reject a community-policing plan developed through the process by the African-American Police Community Relations Board. That set up the Board of Supervisors to successfully override a mayoral veto of police foot patrols.

"Ahsha’s approach was consistent with the Newsom administration, with folks that talk a good game but there’s no substance behind it," said Mecke, who ran for mayor last year, placing second.

Another realm in which Safai has claimed undeserved credit is on his efforts to save St. Luke’s Hospital from attempts by the California Pacific Medical Center (and CPMC’s parent company, Sutter Health) to close it or scale back its role as an acute care provider for low income San Franciscans.

"When I looked at his campaign material and he says he was a leader who saved St. Luke’s, I thought, ‘Am I missing something here?," Roma Guy, a 12-year member of the city’s Health Commission and leader in the effort to save St. Luke’s, told the Guardian. "Nobody thinks Ahsha has taken a leadership role on this. This is a significant exaggeration from where I sit."

Nato Green, who represents nurses at St. Luke’s within the California Nurses Association, went even further than Guy, saying he was worried about Safai’s late arrival to the issue (Safai wasn’t part of the group that protested, organized, and urged CPMC to agree to rebuild the hospital) and the fact that CPMC appointed Safai to its Community Outreach Task Force as the representative from Distrist 11.

"From our point of view, he is the CPMC’s AstroTurf program, simuutf8g community participation," Green told us. "It’s critical to us that we end up with a supervisor who is independent of CPMC and will go to the mat for what the community needs."

CNA has endorsed Avalos in the District 11 race.

"John was the only candidate in District 11 who came out and spoke at the hearings, attended the vigils, and walked the picket line during the strikes," Green said.


REAL ESTATE SPECULATION


Beyond his association with downtown power brokers and endorsement by Newsom, there are other indicators that Safai is hostile to progressive values. He said in a recent televised forum that he would work most closely with supervisors Carmen Chu, Sean Elsbernd, and Michela Alioto-Pier, the three most conservative members of the Board of Supervisors.

During an Oct. 14 Avalos fundraiser hosted by sustainable transportation advocates Dave Snyder, Tom Radulovich, and Leah Shahum, attendees expressed frustration at Safai’s tendency to pander to groups like the San Francisco Bicycle Coalition, taking whatever position he thinks they want to hear without considering their implications or consistency with his other stands.

"It was a no-brainer for the Bike Coalition to endorse John," Shahum, SFBC’s executive director, said at the event, noting Avalos’ long history of support for alternatives to the automobile.

Avalos, who had been hammered all week by mailers and robocalls from downtown groups supporting Safai, said he was frustrated by the barrage but that "we can fight the money with people.

"Ahsha has done everything he can to blur the lines about what he stands for," Avalos said. "Whoever he’s talking to, that’s who he’s going to be. But we need principled leadership in San Francisco."

One area where Safai doesn’t appear to be proud of his work is in real estate, opting to be identified on voting materials as a "nonprofit education advisor." One of his opponents, Julio Ramos, formally challenged the designation, writing to the Election Department that the label "would mislead voters and is not factually accurate, the term ‘businessman’ or ‘investor’ denotes the true livelihood of candidate Safai."

Safai responded by defending the title and writing, "My dates of employment at Mission Language Vocational School were from August 2007 through February 2008." So, because of his seven-month stint at this nonprofit, voters will see Safai as someone who works in education, even though his financial disclosure forms show that most of his six-figure income comes from Blankshore LLC, a Los Altos-based developer currently building a large condo project at 2189 Bayshore Blvd. that is worth more than $1 million. (That’s the top value bracket listed on the form, so we don’t know how many millions the project is actually worth or how much more than $100,000 Safai earned this year).

But we do know from city records that Safai has personally bought at least three properties during his short stint in San Francisco, including one at 78 Latona Street that he flipped for a huge profit after buying it from a woman facing foreclosure, who then sued Safai for fraud.

The woman, Mary McDowell, alleged in court documents that real estate broker Harold Smith, "unsolicited, came to plaintiff’s residence and offered assistance to her because her homes were in foreclosure … [and said] she would receive sufficient money after sales commissions to reinstate the loans on the four other properties."

The legal complaint said Smith then modified those terms to pay McDowell less than promised and arranged to sell the home to Safai and his brother, Reza. "Plaintiff is informed and believes and thereon alleges that defendants did not promptly list her residence on the multiple listing service to avoid larger offers on the home and conspired with the other defendants to purchase the home at a far less than market price," reads the complaint.

The case was originally set for jury trial, indicating it had some merit. But after numerous pleadings and procedural actions that resulted in the plaintiff’s attorney being sanctioned for failing to meet certain court deadlines and demands, the case was dismissed.
But whatever the merit to the case, records on file with the county assessor and recorder show that Safai and his brother flipped the property for a tidy profit. They paid $365,500 for the place in December 2003 — and sold it two year later, in December 2005, for $800,000.
Labor activist Robert Haaland told us that Safai can’t be trusted to support rent control or the rights of workers or tenants: "At the end of the day, he’s a real estate speculator."

Surrealism’s island

REVIEW Since his death in 1966, André Breton has received more than his fair share of knocks. I’ve heard both critics and poets call him "fascist," though if pressed, they can only cite Breton’s sometimes dogmatic leadership of the surrealist movement. Such loose talk is tiresome and ahistorical. A staunch Communist, Breton was nonetheless the first to denounce the totalitarian Stalin when the rest of the French Left turned a blind eye. He never went for Mao like the Tel Quel crowd. As leader of a left-wing movement opposed to Hitler, he was on the Nazis’ Parisian to-do list, and he only narrowly avoided arrest by Vichy authorities in Marseille, escaping to America aided by the efforts of Varian Fry (a sort of Schindler for lefty artists). Breton’s even occasionally criticized for fleeing the Nazis — as if it contradicted his principles — though his accusers tend to lead safe, academic lives. As we see in Martinique: Snake Charmer (University of Texas Press, 96 pages, $19.95), a chronicle of Breton’s stopover between Marseille and NYC, exile’s no picnic.

Breton had his flaws, of course, notably sexism and homophobia, yet even these were complicated, given the number of women and gays within the surrealist group. Most of his positions were politically progressive, particularly his anti-colonialism and anti-racism. Where much of the modernist avant-garde (Pound, Eliot, Marinetti, etc.) was avowedly racist, surrealism was the only movement that welcomed black artists as colleagues and innovators. In Martinique, in reference to the poet Aimé Césaire (who died only a few months ago, at 94), Breton writes: "It is a black man who handles the French language as no white man today is capable of handling it

. . . who is the one guiding us today into the unexplored." (Similarly, Breton would declare the Haitian Magloire Saint-Aude the most important surrealist poet of the post-war period.) Where more sympathetic artists like the Cubists exoticized Africans, Breton identifies with Césaire, "unable to distinguish his will from my own." This might seem naïve in today’s political climate, yet the testimonials by the Martinican and Haitian writers who met Breton in the ’40s — translated in Michael Richardson’s 1996 book Refusal of the Shadow — suggest the feeling was mutual. Maybe it’s not so naïve, for surrealism stretches the limits of the possible.

Like many surrealist books, Martinique is a hybrid work, alternating between "lyrical language" and "the language of simple information," reflecting "intolerable malaise on the one hand and radiance on the other." That Breton could still pursue the poetic marvelous under such trying conditions — on arrival, he’s thrown into a concentration by the pro-Vichy regime and, once freed, is constantly shadowed by police — is extraordinary. He was fascinated by Martinique’s natural beauty, celebrating, for example, the effect of rainfall on the island in surrealist terms: "If the light is the least bit veiled, all the sky’s water pierces its canopy, from a rigging of vertigo, water continually shakes itself, tuning its tall green-copper organ pipes." Not even the uncertainty of his fate could stop Breton’s imagination.

This edition of Martinique — the first in English — is not without drawbacks, the most egregious being the poor reproductions of André Masson’s drawings, seemingly scanned from the French edition. But the translation is admirable. In a society which falsely imagines itself "post-racial," Martinique is essential reading. *

Anniversary Issue: Culture isn’t convenient

I live near Church and Market streets, which means I’m stumbling distance from an organic grocery store, my favorite bar, several Muni stops, and a 24-hour diner. It also means the street outside my apartment is usually loud, the gutters are disgusting, there are rarely parking spots, and transients sleep, smoke, panhandle, and play really bad music near my front doorstep.

Actually, until recently, they did a lot of this on my front doorstep. Then the landlords — without asking us first — installed a gate. And I hate it. Yes, my stairs are cleaner. I suppose my stuff is safer. But I’m no longer as connected to my community. I’m separated from the life that’s happening on the street — the very reason I moved to this neighborhood in the first place. I fear I’ve lost more than I’ve gained.

Lately our city’s approach to entertainment and nightlife has been like that fence. While protecting people from noise, mess, and potential safety concerns, we’re threatening the very things we love about this city. Thanks to dwindling city budgets and increasingly vocal NIMBYs, it’s becoming increasingly more difficult to manage nightclubs, plan street fairs, and organize outdoor festivals. And as we continue to build million-dollar condos at a brisk place, the city is filling up with affluent residents who may not appreciate the inherent messiness of city living. We’re at risk of locking away (and therefore losing) the events that make this a vibrant place where we want to live.

The recent history of this issue can be traced to the 1990s, when dot-com gold brought live/work lofts to otherwise non-residential neighborhoods — and plenty of new residents to live in them. Those newcomers, perhaps used to the peace and quiet of the suburbs, or maybe expecting more comfort in exchange for their exorbitant monthly rent checks, didn’t want to hear the End Up’s late-night set or deal with riffraff from Folsom Street Fair peeing in their driveways. Conflicts escalated. The Police Department station in SoMa, responsible for issuing venue permits and for enforcing their conditions, embarked on a plan to shut down half the area’s nightclubs. Luckily, city government and citizens agreed to save the threatened venues and the police captain responsible for the proposal was transferred to the airport, the San Francisco equivalent of political exile. In 2003, the Entertainment Commission was formed, in part to take over the role of granting venue and event permits.

But as Guardian readers know, the problem was not solved. As we’ve covered in several stories ["The death of fun" (05/23/06), "Death of fun, the sequel," (04/25/07), "Fighting for the right to party" (07/02/08)], beloved events and venues are still at risk. How Weird Street Fair was forced to change locations. Halloween in the Castro District was cancelled altogether. Alcohol was banned at the Haight Ashbury Street Fair and restricted at the North Beach Jazz Festival. Fees are still increasing. Rules are getting more stringent. As we predicted, it’s getting harder and harder to have fun in San Francisco. And while it’s the job of the Entertainment Commission to prevent problems while protecting our right to party, it has never been given enough funding, staff or authority to properly do its job.

So why should we care? Our legendary nightlife, festivals, and parades bring international tourists to our city — where they stay in hotels, eat at restaurants, shop at stores, and otherwise pump money into our economy. Street fairs give us ways to connect to our neighbors and our neighborhoods. Free events (which, if permit fees increase and alcohol sales are prohibited, will be a thing of the past) give equal access to fun and frivolity to people in all income brackets — and most raise money for charities and nonprofits. Particular venues and happenings provide an important way for those in the counterculture — whether that’s LGBT youth or progressive artists — to meet, mingle, and support each other. And none of that captures the intangible quality of living in a city where freedom, tolerance, and the pursuit of a good time are supported. And all this is one of the reasons many of us moved here, where we pay taxes (and parking tickets), open businesses, start organizations, and contribute to our already diverse and vibrant population.

But if we don’t establish a way to protect our culture, personally and legally, we may lose it. Instead, we need an overarching policy that establishes our values as well as the legal ways we can go about supporting them. The Music and Culture Charter Amendment, in the works for more than three years and currently sitting before the Board of Supervisors, aims to do exactly this.

The most important part of the amendment, created by a coalition of artists, musicians, event planners, club owners, and concerned citizens who call themselves Save SF Culture, would be to revise San Francisco’s General Plan to include an entertainment and nightlife element, just as the current plan contains an entire section devoted to the protection of (presumably mainstream) dance, theater, music, and art, calling them "central to the essence and character of the city." Not only would this amendment mandate that future lawmakers try to preserve events and venues, it would give a roadmap on how to do this effectively — most notably by creating a streamlined, transparent, online permitting process for special events.

Yet even if this important amendment passes and wins the mayor’s signature (which is hardly a sure thing), that’s just the beginning of a process of figuring out how to sustain San Francisco’s culture in the face of potentially threatening socioeconomic changes. At the very least, the next step will be giving the Entertainment Commission the full funding and staff (it currently operates with five of the eight staffers required). And once our beloved clubs and events are out of immediate danger, it will be time to form a coalition of citizens, government officials, and city planners to decide how and where culture in our city should grow, asking questions like whether or not we want a large-scale amphitheater or if we need to designate an area as an entertainment district. Most important, the city needs to develop a framework for resolving the inevitable conflicts with NIMBYs in a way that promotes a vibrant culture.

Yet there’s also a role in this process for each citizen of San Francisco. We need to remind ourselves and our neighbors that tolerance is one of our core civic values, tolerance for different races, classes, genders, sexual identities, and for the potentially noisy, messy, chaotic ways our culture supports those differences. If we erect a gate — physical or metaphorical — every time we’re uncomfortable or inconvenienced, we’ll turn San Francisco into the sanitized, homogenous, boring suburbs that I moved to Church and Market to escape. *
