Alas, word has come on the hot gay wires that fabulously risquee night club chanteuse of the ’40s and ’50s, Ruth Wallis, has passed from Alzheimer’s.

Wallis, progenitress of such incredibly double entendred tunes as “Hopalaong Chastity,” “The Dinghy Song” (“Davey had the cutest little dinghy in the Navy”), and, a personal favorite, “A Man, a Mink, and a Million Pink and Purple Pills” — and who was the inspiration for 2003 Off-Broadway tribute “Boobs! The Musical” — was 87.

Someone has just expunged all of her online clips (heirs already planning to cash in, perhaps?) but below is a fine Victrola-type dealie spinning “Johnny Had a Yo-Yo.” Blush and sing along with us, for Ruth.

Though orchestra leader and electronics pioneer Raymond Scott may not exactly have been a household name, his sonic inventiveness succeeded in seeping across the larger social synapse of America’s television generation. Credited with founding 20th-century music’s dubiously named exotica genre — a kind of pop counterpart to art brut that included everything from Claude Debussy’s Javanese tribalism to Clara Rockmore’s theremin, Arthur Lyman’s vibes and chimes to electronic voice phenomena séances — Scott created a corpus that was as unique as it was bizarre.

In fact, Scott’s variety of assorted musical approaches was extraordinary: he composed everything from syncopated so-called cartoon jazz to proto-synthesizer radio jingles to ambient albums for toddlers. "The concept of electronic music for babies in the early 1960s usually strikes folks as either extremely clever and useful or totally insane," says Jeff Winner, aficionado, RaymondScott.com archivist, and coproducer of many Scott reissues. And truly, Scott’s role as a radiophonic designer and a thoroughly American surrealist in the autodidactic tradition of Joseph Cornell or Stan Brakhage is unparalleled in the almanac of recorded music.

It’s appropriate, then, that this new year marks the centennial anniversary of the birth of a man in whose absence the ether of the 20th century may have sounded radically different — or, at the very least, would have had fewer blurbs, blips, and zoinks. In celebration, the Raymond Scott Archive and Basta Records — the geniuses behind the comprehensive Manhattan Research Inc. (2000) and the 1997 reissue of Scott’s Soothing Sounds for Baby, Volumes 1–3 (Epic, 1963) — are planning a yearlong audio bacchanal that will revisit every major era in the composer’s 50-year career. According to Winner, this will include the release of a documentary by Scott’s only son, Stan Warnow; a series of electronic and jazz rarities recordings; and live tribute concerts on the East and West Coasts.

Born Harry Warnow in 1908 to a Jewish Russian immigrant family in New York City, Scott pursued his early passion for science and music by attending a local Brooklyn technical school before entering the Institute of Musical Art (later the Juilliard School) in the late 1920s. He began his professional career as an in-house musician at CBS, where he worked in varying capacities for the television and radio network — as a session man, orchestra conductor, and creative director — for decades.

In the interim, the always resourceful musician recruited five compeers and formed the Raymond Scott Quintette — so called because, according to Scott, using the correct "<0x2009>‘sextet’ might get your mind off music." Under Scott’s direction, the Quintette produced a striking oeuvre that blended the compositional and stylistic aesthetic of big band jazz, the amorphous motifs of soundtrack and sound effects records, and the playful narratives of Gilbert and Sullivan operettas. The song titles alone are surrealism in miniature — "New Year’s Eve in a Haunted House," "Dinner Music for a Pack of Hungry Cannibals," "In an Eighteenth Century Drawing Room," and Scott’s most celebrated and oft-repeated piece, "Powerhouse." So successful were these instrumentals that within months of their debut the Quintette were contracted with 20th Century Fox to score major motion pictures. These songs would also become the adolescent soundtrack of Saturday morning after Warner Bros. secured the rights to the Quintette’s catalog in 1943 and Warner musical director Carl Stalling inserted huge swathes of Scott’s work into the immensely popular Looney Tunes.

Using the generous salary from his work at CBS, Scott bankrolled his own electronics studio — a sort of junior BBC Radiophonic Workshop — which he christened Manhattan Research in 1946. Though its initial function was to produce radio ads and jingles, the Long Island, NY, laboratory’s true purpose was to develop unheard and unimagined forms of electromechanical and synthesized tones. Predating the widespread use of integrated circuits and analog synthesis, the photocell tone generators and polyphonic sequencers constructed at Manhattan Research were completely unprecedented in sound technology.

"Given the amazing, tiny, and cheap technology that’s everywhere today, it’s a real challenge for us moderns to appreciate how difficult and s-l-o-w the process was," Winner explains. "It was always laborious, tedious, and extremely time-consuming. Designing, theorizing, soldering, then testing…. Wiring, rewiring, and testing again and again…. Hour after hour, year after year — literally — decade after decade."

The records spawned from these contraptions — the Clavivox, the Electronium, and the Circle Machine — often consisted of limpid pools of sustained sound multitracked with sharp sine wave helices and processed glitches. The almost childlike primitivism and free-form tonality that template Scott’s work bely its enchanting subtlety, prefiguring the kraut rock pastoralism of Brian Eno and the lush microtones of contemporary digital artists Christian Fennesz and Nobukazu Takemura. In fact, Winner recalls that when a colleague introduced Eno to Scott’s music years ago, Eno "was indeed impressed. He agreed that some of Scott’s electronic music is similar to some of his own."

Though his success as a producer and inventor was subordinated to his very popular role as an orchestra conductor and jazzman — creating a kind of night-and-day personality that alternated between the smiling TV bandleader and the dial-twisting mad scientist — Scott continued his nocturnal research unabated. Along the way, the once-gregarious musician became more obsessive and secretive regarding his unwieldy instruments, some of which extended wall to wall with their untranslatable, blinking consoles.

The fruits of his labor only became clear later, as the impact of Scott’s brilliance was measured in the younger technologists and musicians who joined his mission in the ’50s and ’60s. Budding musical technician Robert Moog began working with Scott long before he invented the first modular synthesizer that bears his name. Motown impresario Berry Gordy was so impressed with Scott’s mysterious Electronium that he recruited the inventor to the label’s expanding R&D department and bankrolled Manhattan Research’s 1971 move to California, where Scott would spend his final professional years toiling unapologetically on the apparatus.

"During [those years,] among the very few who were thinking about electroinstruments, no one foresaw a consumer market for hardware," Winner explains of Scott’s lifelong work. "Almost no one wanted those kinds of sounds yet." With this centennial celebration — and a bevy of new studio discoveries — Scott’s work may finally be recognized for its uncompromising beauty and understood as the revolving soundtrack for a century of technology and dreams, human and machine.

Year in Film: Western promises

Though it’s been pronounced dead so often and for so many years, the western lived again in 2007, sprouting like a gnarly weed through a cracked desert shelf. These new-millennium westerns, however, are a little tougher, a little wiser, and more prone to fits of sadness and moments of darkness.

It is said that most, if not all, American presidents since 1952 have screened High Noon (1952), one of the old model westerns, at the White House, and some have claimed it as their favorite movie. Our current cowboy president probably loves it more than all of his predecessors did, and it’s as likely as not that he watched it at least once during the past 12 months. No doubt he, like the other commanders in chief, saw himself in the movie, alone and standing strong against terrible odds with no help at all from cowards and city-bred folk.

Fifty years ago Delmer Daves directed the original 3:10 to Yuma very much in the mode of High Noon, with a single-minded hero, Dan Evans, standing up for a purpose against all reason and despite everyone urging him to quit. He will, come hell or high water, transport the bandit Ben Wade to the title train on time. James Mangold’s new remake sticks close to the original but also departs in significant ways. This time a third character figures prominently in the action, Ben Wade’s right-hand man Charlie Prince (Ben Foster), a pale, small fellow with a sadistic swagger and a penchant for exploding into wildly inappropriate violence.

It’s fairly easy to read Charlie’s devotion to his boss (Russell Crowe) as a kind of desperate man love. It’s Charlie who makes the film’s ending something quite different from the original’s hopeful turn. Mangold’s skillful storytelling means it’s possible to enjoy the film purely on the level of a bread-and-butter western, but he also quietly suggests the United States’ headfirst march into the quagmire of Iraq.

Similarly, Jesse James has graced all kinds of classic westerns, but never quite like in Andrew Dominik’s The Assassination of Jesse James by the Coward Robert Ford. This James is no longer a hero of the people fighting greedy railroad men but now merely a lost celebrity both fascinated by the limelight and weary of its glare. The film deliberately turns up its nose at gunplay and action and instead focuses on the rotting final months of the legend’s life, when the cancerous Ford (a perfectly sniveling Casey Affleck) enters. It plays out like a long, slow chess game, easing through its 160 minutes with a kind of watchful caution.

A typical scene has James (Brad Pitt) sizing up his colleagues from across a table, reading their fears and desires through their eyes and twitches. When the title moment comes, it plays like a transfer of fates, with James deliberately passing on the mantle to his young admirer. But the mantle quickly strangles, and Ford spends the rest of his days forever attached to and defined by that one moment, hated and hounded. This is a western that arrives in David Lynch–ian territory after having passed through Terrence Malick land, and the cowboy’s heroism and self-reliance have dried up along the way.

If Yuma and Jesse James are more comfortable for being based in the past, then No Country for Old Men is something a good deal darker: it’s a modern-day western masterpiece, set in the 1980s, with horses and cowboy hats. It pries open the end of the West and finds despair. The hunter (Josh Brolin) and the killer (Javier Bardem) are both cynical products of the Vietnam War, relentless in their thinking and planning and unable to trust or rest. The sheriff (Tommy Lee Jones) is the linchpin, the old man whose country no longer belongs to him and who can’t comprehend what happened to it. It’s because of westerns like these, which examine the genre like grim ghosts presiding over their own autopsies, that so many have pronounced the genre dead over the years.

Even if the cowboy president didn’t fit into this new strain of western in 2007, he did appear — either directly or as a kind of offscreen presence — in a far different kind of film. One could make a case for these as mutant westerns, featuring a bunch of Dan Evanses trying to bring their Ben Wades to the train against all odds and reason: Sicko, No End in Sight, Operation Homecoming: Writing the Wartime Experience, The Kingdom, Rendition, Lions for Lambs, In the Valley of Elah, Redacted, and Grace Is Gone. If you look hard enough, you can even see him in the margins of Paul Thomas Anderson’s bizarre, oil-soaked quasi western, There Will Be Blood.

It’s doubtful that any of these movies will be screened at the White House soon. No, the year’s most likely cowboy to push through those swinging doors is none other than Sam Elliot in The Golden Compass, a traditional cowpoke in an unfamiliar setting, complete with "howdy"s and "I reckon"s, uttered among a swirling sea of CGI. More than the other cowboys, the current president could recognize and identify with him: conventional, simple, and perhaps a bit lost. *

OK, I wish my life were like that — I’m allergic to cheap cognac — but holy crap. Has it really been two decades since intricately striking comedienneuse Sandra Bernhard, who snarkily uttered the words above, tickled homos pink and sent confounded heteros down the Stoney End with her "Without You I’m Nothing" tour? Lorf, my mints are dusty. Somebody hand me a tambourine! Come back, come back to the Five and Dime, Barbra Streisand, Barbra Streisand!

Wow. That was really gay, even for moi. Somebody hang me in Saudi Arabia.

Slutting it up with a crooked-toothed Madonna, slapping down Roseanne’s sloppy joes, grouching through Sesame Street Presents: Follow That Bird — this is all but winceworthy water under the bridge of the fierce-at-52 Ms. Sandra’s exquisite, seemingly unrestructured nose. And who could ever forget her immortal early ’90s safe-sex rap "Wanna touch my pussy, wanna taste my jam? / Gotta be usin’ a dental dam." Not me, that’s who.

Lucky for us all, Sandra’s planning a 20th anniversary tour of "Without You I’m Nothing" next year, but until then she’s wetting our whistles with a New Year’s Eve extravaganza at the Castro Theatre. She rang me up for a quick chat about the glory of her upcoming appearance.

SANDRA BERNHARD Darling! How are you?

SFBG Gurl, I’m hungover as usual — and George W. Bush is totally fucking up the global climate summit in Bali right now. I’m frantically fast-forwarding myself into 2009.

SB Don’t I know it, child. I watched the Democratic debate the other day, and I was weeping. I cannot wait for any one of them to win. Meanwhile I’m just keeping myself busy, spending time with my family [partner Sara and nine-year-old daughter Cicely], and basking in quiet limelight.

SFBG At the end of this month you’re doing two nights in Atlanta and then immediately flying to San Francisco on New Year’s Eve. I noticed on your holiday gift wish list you’ve asked for a lot of protein bars, cinnamon gum, and organic cosmetics. Is that how you stay so fresh?

SB I’ve also got a world music album and new film, See You in September, coming out next year. You know, it looks like I’m doing a lot, but really I do a show or two, take a day off to center myself, and get back out there, ready for more. I can’t wait to be in San Francisco — such a fun city, full of amazing people.

SFBG You were here in November to judge the Miss Trannyshack Pageant. I bet you got a lot of wig in your teeth that night.

SB It was a wild ride that seemed like it would never end.

SFBG So what can we expect at your New Year’s show? "Everything Bad Is Beautiful" with a balloon drop?

SB Are you kidding? People these days can barely sit still for 20 minutes, let alone watch a whole show on New Year’s Eve. I’m planning a kind of variety spectacular. Video clips, some stand-up, a bunch of songs.

SFBG Your art has always been about tearing down the whole idea of celebrity. It’s like you were foretelling our current moment when you said, "To be superfamous you need to act like a total freak."

SB It’s so true! I think in this country we’ve just given up. We’re burying our heads in whatever fucked-up, methed-up, Britney–Paris–Paula Abdul disasters are spoon-fed to us. I mean, I tear those girls apart in my shows, but even doing that is giving them more dimensions than they actually deserve.

SFBG Most of my readers are total fashion whores. You always look so together. Who are you wearing lately?

SB Zac Posen, Marc Jacobs, Juicy Couture, Stella McCartney, Alexander McQueen, and I love this Israeli designer named Nili Lotan. It’s a mix. But you’ve gotta watch out — there’s too much cheap knockoff shit out there.

SFBG You’ve been such an inspiration to most of the dykes I know.

SB I love young gay women — they’ve caused a revolution. They’re more free with their money. They’re jaunty. I have this story I tell where I went to lunch with this older friend. The waiter asked if she wanted more corn bread, and she was, like, "Sure!" Then she turned to me and whispered triumphantly, "It’s free." And I was, like, why don’t you just pay for the damn corn bread if you like it so much? Just pay for it and enjoy it. That’s my message to the world: enjoy your corn bread. *

Green City: The baby question

GREEN CITY I remember exactly where I was — sitting on a BART train, reading yet another magazine article about global warming — when it hit me harder than ever before: the year 2050 is going to suck.

Predictions suggest it’s going to be hotter, colder, drier, wetter, and stormier in all the wrong places. Sea levels will be up. Resources will be down. The view from 2007 is not good. So how can I, an educated, middle-class American woman, reasonably consider having a child with such a future to offer?

To have or not to have is the baby question everybody asks. I’ll admit I’ve been on the fence for a long time. A survey of my female role models reveals that exactly half took the motherhood plunge (including my own mother), yet the other half refrained. I’m clearly drawn to the childless life for a number of reasons, and reading the International Panel on Climate Change reports released this year has given me one more.

By virtue of our existence, we’re all contributing to global warming, and my impact will be at least doubled by every child I have. According to Al Gore’s carbon calculator (at www.climatecrisis.net), I’m emitting 2.35 tons of carbon dioxide per year, well below the national average of 7.5. But that would certainly increase if I were to have a baby. I’d need a bigger place to live, and that would require more heat and electricity. More flights back East to see Grandma and Grandpa would be in order, and I’d probably buy a car, not to mention all that crap that babies need.

I would become more like the average American, who has a life span of 77.8 years and, according to estimates by the Mineral Information Institute in Golden, Colo., needs 3.7 million pounds of minerals and energy fuels to construct and support a lifetime of stuff — from cars and roads to batteries and soap.

It seems like an effective way to cut our impact on the earth would be to cut population, yet such a strategy almost never comes up.

"In the entire discussion of climate change, there’s been no mention of population," Paul Ehrlich, Bing Professor of Population Studies at Stanford University, told me.

The IPCC’s fourth assessment, released in November, discusses mitigation measures but never suggests decreasing population — except as the unintended result of a natural disaster. Historic attempts to limit population growth have never been popular. China has been chastised for its one-child policy, as were environmental groups like the Sierra Club, which called for limiting immigration in the 1970s to curb population growth in the United States.

"It’s an incredibly personal decision," environmentalist and author Bill McKibben told me. "In our culture it’s not one that’s easy for people to talk about." He addressed it in Maybe One (Simon and Schuster, 1998), in which he explains his decision to have a child after years of saying he and his wife wouldn’t.

McKibben says he wrote the book to uncover the weak mythology that only children are spoiled, myopic brats, to show how religious beliefs have been manipulated, and to point out that an increasing population is really an economic advantage.

Ehrlich, who thinks the US should at least have a population policy, also had one child with his wife, Anne. The realization that having more would contribute to an unsustainable future for their daughter led them to author numerous books on the subject, including The Population Bomb (Ballantine Books, 1968), one of the bellwethers on the impact of unchecked population growth. Since then the issue has essentially disappeared from public consciousness, and Ehrlich thinks that’s because the world’s total fertility rate has, in fact, dropped — from five children per woman to three. In the US it’s decreased even further, to less than the replacement level. This has created the impression that population is no longer a problem.

But that’s not entirely true. While birthrates may be down, the overall population has still grown, because life expectancy has increased. Most of us don’t die when we give birth. We go on living, breathing, eating, drinking, shitting, idling in traffic, jetting between cities, and consuming more and more of the dwindling resources we have — with a child or two at our side.

And the equation is simple, right? The more people, the bigger the problem.

"Well, it’s not a direct multiplier," McKibben said. He offers as an example an Amish family of eight "living simply" and having less of an impact than the average American Brady Bunch. "In global terms it’s so much more about consumption."

Ehrlich and McKibben agree that’s really the problem. "An important point, which is usually missed, is the next 2.5 billion people are going to have a much bigger impact than the last 2.5 billion," Ehrlich said.

According to his research, we’ve surpassed the earth’s carrying capacity, and Americans are only able to overconsume because Africans, Indians, Asians and other developing countries are underconsuming.

If the entire world population ate and drank and drove around like Americans — which is the aspiration of many — we’d need two more Earths.

"The current population is being maintained only through the exhaustion and dispersion of a one-time inheritance of natural capital," the Ehrlichs and Gretchen Daily wrote in the 1997 book The Stork and the Plow (Yale University Press), in which they grapple with the question of a sustainable population for Earth.

Their answer: about two billion. How many are we now? Worldwide, 6.5 billion, which will rise to about 9 billion by 2050 — with most of the growth slated for developing countries. Family planning and education are largely considered the primary factors in keeping the US population under control, and that’s where international efforts have focused, according to Kristina Johnson, population expert for the Sierra Club.

This has required an artful dance around the Mexico City Policy, in place in one form or another since 1984, when Ronald Reagan refused aid to any international agencies that use any monies for abortions. So while we’ve managed to handle our head count at home, we’ve done the opposite abroad.

As for how to deal with our enormous abuse of natural resources, technology has long been hailed as the solution. The guiding principle has been that our children will be smarter than we are, so we’ll leave it up to them to figure it out. However, as the Ehrlichs conclude in their most recent book, One with Ninevah (Island Press, 2004), "The claim that ‘technology will fix the problems’ has been around for decades — decades in which the putative advantages of claimed technological ‘fixes’ have often failed to appear or proved to be offset by unforeseen nasty side effects."

For example, we essentially avoided large-scale famine by figuring out how to reap more crops from our soil. But we haven’t mastered how to do this without the use of pesticides and, increasingly, genetically modified organisms that have transformed diverse farms into precarious monocultures.

Today we’re counting on technology even more, but some of the proposed solutions still raise questions. Do we have enough acreage to grow biofuels? What would be the long-term impacts of capturing carbon emissions and burying them underground? Ditto for spent nuclear fuel.

And all of these variables factor in those 2.5 billion people to come, without suggesting people consider not having children.

If there’s a mantra for any concerned citizen to adopt, it should be less. Use less. Buy less. Be less of a draw on the system. But as Richard Heinberg writes in Peak Everything (New Society, 2007), "People will not willingly accept the new message of ‘less, slower, and smaller,’ unless they have new goals toward which to aspire."

Cutting carbon emissions is a serious goal, and it looks like leadership is going to have to come from within. The Bali talks have produced no binding agreement except … more talks.

Our elected representatives have finally raised US fuel-economy standards for the first time since 1975, to the slightly less shameful level of 35 miles per gallon by 2020. Environmentalism is peaking as a popular movement, but the credo to consume less has been divorced from its consciousness.

"Green" products are now the fastest-growing consumer market. In fact, this holiday season you can buy a pair of chic Little Levi’s for your kid. They’re just $148 at Barney’s, and "a portion of proceeds" will go to the Trust for Public Land. How much? Who knows? The company isn’t saying. Just shut up and shop and don’t worry about it — they’re organic. *

Reining in the UC

EDITORIAL The deal that’s slated to turn a former University of California campus into a private housing development in San Francisco is another demonstration of a long pattern of problems between the UC and local governments. Put simply, the university is a bad neighbor and a bad actor — and it’s time the State Legislature did something about it.

The history of local communities fighting the UC is legend in this state, dating back at least to the People’s Park battles in Berkeley in the 1960s, and today that city is fighting the school’s plan to build a new sports stadium. In San Francisco the UC has tried to run over local planning laws to build a garage at Hastings College of the Law, is angering neighbors with its expansion plans at Mission Bay — and is now in the spotlight at 55 Laguna Street, the site of an old UC Extension campus.

The university wants to let A.F. Evans Co. build 440 units of housing — much of it high-end, with an average rent of $4,000 per month — on the 5.8-acre site. Only 15 percent of the units would be available below market rate.

Sup. Ross Mirkarimi has been trying to increase the number of affordable units but has run into a giant obstacle: the UC is demanding $18 million for the land, and it won’t budge an inch. In fact, the university has told him it’s prepared to drop the whole deal and walk away (leaving the campus empty and crime-infested and angering its neighbors) if the city tries to get a penny of that lease money.

We recognize that, like every other state agency, the UC desperately needs cash — but we’re sick of university officials acting arrogant, refusing to deal in good faith, and threatening to use the power of a state agency to bypass local land-use laws. While San Francisco struggles to make the 55 Laguna project work, the State Legislature ought to find a way to force the UC to work with local governments — and remove its ability to circumvent local laws.

Don’t accept Bike Plan delays

EDITORIAL The way city officials are describing the situation, it’s going to be another 18 months at least before San Francisco can add even a single bicycle lane or road stripe or put in a single new bike rack. That’s because a lone nut who thinks bicycles shouldn’t be on the city streets sued San Francisco and forced it to do an environmental impact report on its Bike Plan. And that report has been delayed and delayed again as city planners have been unable to complete it.

That’s infuriated some advocates, including Sups. Ross Mirkarimi and Tom Ammiano — and for good reason. The San Francisco Planning Department seemed to have no problem whatsoever forcing an EIR on the 55 Laguna Street development project onto the fast track, but the Bike Plan … that’s just creeping along.

And in the meantime, bicyclists and pedestrians continue to be run down at some of the most hazardous intersections in town, particularly Fell and Masonic streets and Octavia Boulevard and Market Street. City figures show that Fell and Masonic is one of the most dangerous places in town for pedestrians and bikers; the San Francisco Bicycle Coalition reports that at least eight collisions between cars and bike — all of them causing injury to the rider — have occurred at the intersection since April. It’s not an acceptable situation, and with a little creativity, the city ought to be able to do something about it.

The lawsuit, brought by blogger Rob Anderson, claims the city failed to do a complete EIR before approving its Bike Plan. That’s put everything — even the restriping of pavements for safer bike lanes — completely on hold.

In a sense, it’s absurd to have an environmentally positive change — a city policy promoting bicycling — held up by environmental law. But the California Environmental Quality Act and the way the city is interpreting it still have roots in the era when automobile traffic was considered the most important form of urban transportation.

For example, CEQA requires cities to evaluate how projects would impact traffic — and San Francisco has always used a yardstick called "level of service," or LOS, which refers to the number of cars using a particular intersection and the speed at which those cars can proceed. If a project slows down car traffic beyond an acceptable level, there’s an environmental impact that has to be addressed.

But that’s a backward analysis; the city’s job shouldn’t be to find ways to facilitate more cars on busy streets. And it allows bizarre interpretations: if, for example, the addition of a bike lane on a street reduces the available space for cars, that ought to be looked at as a positive environmental step; the city interprets it as a negative impact.

State senator Carole Migden has discussed legislation that could exempt bike plans from CEQA, and while we’re nervous about any exemptions to the state’s premier environmental law, that might make some sense. But it might not even be necessary.

San Francisco’s city planners are still looking for ways to accommodate cars — all of the city’s development policies are based on the assumption that the number of private vehicles in San Francisco will increase over the next 10 years. An assumption like that leads to mandates for more parking, wider roads, and (maybe) fewer bike lanes.

But there’s nothing in the law requiring the pro-car approach. The Planning Commission could simply adopt new rules that define the level of service on streets differently. Instead of tracking how many cars go through an intersection, the city could track the number of people — including people on foot, people on bikes, and people in buses — and made a determination that pedestrian and bike safety and the quality of the travel experience for non–car users is as important as the degree of auto traffic.

That simple change would render much of the Anderson suit moot: new bike lanes, for example, would no longer be a potentially adverse impact. The city could move forward with much of its bike plan, now.

CEQA doesn’t require cities to accept public safety hazards — and the law clearly creates exemptions for situations in which lives are at risk. Mirkarimi has proposed legislation to change the LOS system, but it has languished; the supervisors need to move on it if the city planners won’t. You don’t need an EIR to tear down a freeway that’s about to collapse — and you shouldn’t need an environmental review to fix the most dangerous intersections in the city, including Fell and Masonic. City planners should simply define those hazardous sites as imminent dangers to public safety and immediately start changing the traffic lights, rerouting cars, and redefining bike lanes to put an end to the carnage, now.

Polishing SPUR

Wedged among the commerce, tourism, and white-collar businesses north of Market Street is the slim entry to 312 Sutter, easy to miss unless you happen to be searching for the San Francisco Planning and Urban Research Association. SPUR occupies the fourth and fifth floors of the building — and occupies them completely. Cubicles are close and overstuffed. Conversations compete. Space for meetings is a hot commodity. Four bicycles, ridden to work by staff members, are crammed in a side room where languish a half century’s worth of policy papers, photographs, and planning documents generated by the active public interest think tank.

It looks more like a struggling nonprofit than one of the most influential policy organizations in town, one supported by the city’s richest and most powerful interests.

"This is why we’re building the Urban Center," said Gabriel Metcalf, the youthful executive director of the 48-year-old organization, clad in a dark suit and sipping from a Starbucks coffee cup while he roams the fourth floor office space searching for any available real estate to sit and talk.

He settles on an open-faced workroom with empty seats. They circle a table covered with a thick ledger of plans for SPUR’s new Urban Center, a $16.5 million, 12,000-square-foot four-story building at 654 Mission that the group is building with more than $8 million in public money.

Plans for the center include a free exhibition space, a lending library, and an evolution of the group’s current public education program, now consisting of noontime forums, to include evening lectures and accredited classes. Though the center will house meeting rooms for SPUR’s committees and offices for its staff, the suggestion is that the new space will be a more public place.

And SPUR seems to be searching for a new public image.

For years the organization was synonymous with anything-goes development, ruinous urban renewal, and an economy policy that favored big business and growth at all costs. Today SPUR’s staffers and some board members present a different face. The new SPUR features open debate and seeks consensus; phrases like sustainability and public interest are bandied about more than tax cuts and urban renewal.

But San Francisco progressives are a tough crowd, and SPUR’s history — and, frankly, most of its current political stands — makes a lot of activists wonder: Has SPUR really changed its spurs? And can a group whose board is still overwhelmingly dominated by big business and whose biggest funders are some of the most powerful businesses in town ever be a voice of political reason?

As one observer wryly noted, "I’ve yet to see SPUR publicly denounce a development project."

SPUR considers itself a public policy think tank, a term that conjures an impression of lofty independence. But the group has, and has always had, a visible agenda. SPUR members regularly advocate positions at public meetings, and the group takes stands on ballot measures.

And it has a painful legacy. "We have a dark history," Metcalf admits, referring to the days when "UR" stood for "urban renewal," often called "urban removal" by the thousands of low-income, elderly, and disabled people, many African American and Asian, who were displaced by redevelopment in San Francisco.

That history — and the fact that SPUR’s membership is largely a who’s who of corporations, developers, and financiers — has caused some to raise questions about the public money the group has received for the new Urban Center.

"They’re not an academic institution," said Marc Salomon, a member of the Western SoMa Citizens Planning Task Force who’s butted heads with the group. "There’s no academic peer review going on here. The only peer review is coming from the people who fund them."

Yet prominent local progressives like artist and planning activist Debra Walker, veteran development warrior Brad Paul, and architect and small-business owner Paul Okamoto have joined the SPUR board in recent years. "There’s a bunch of us that have come in under the new regime of Gabriel Metcalf because there’s a real aching need for a progressive dialogue about planning," said Walker, who thinks SPUR is making concerted efforts to inform its policies with the points of view of a broader constituency. "I think SPUR is engaged in those conversations more than anyone."

SPUR defines its mission as a commitment to "good planning and good government." Though a wide range of issues can and does fall under that rubric, the 71 board members and 14 staff tend to focus on housing, transportation, economics, sustainability, governmental reform, and local and regional planning, and their agenda has a dogged pro-growth tinge.

SPUR likes to trace its history to the post–1906 earthquake era, when the literal collapse of housing left many people settling in squalid conditions. The San Francisco Housing Association was formed "to educate the public about the need for housing regulations and to lobby Sacramento for anti-tenement legislation." A 1999 SPUR history of itself places its genesis in the Housing Association, though other versions of the group’s history suggest a slightly different taproot.

According to Chester Hartman’s history of redevelopment in San Francisco, City for Sale (University of California Press, 2002), the 1950s were a time when corporate-backed regional planners were envisioning a new, international commercial hub in the Bay Area. They were looking for a place to put the high-rise office buildings, convention centers, and hotels that white-collar commerce would need. Urban renewal money and resources were coming to the city, and San Francisco’s Redevelopment Agency identified the Embarcadero and South of Market areas as two of several appropriate places to raze and rebuild.

The agency, however, was dysfunctional and couldn’t seem to get plans for the Yerba Buena Center — a convention hall clustered with hotels and offices — off the ground. The Blyth-Zellerbach Committee, "a group the Chamber of Commerce bluntly described as ‘San Francisco’s most powerful business leaders, whose purpose is to act in concert on projects deemed good for the city,’<0x2009>" as Hartman writes, commissioned a report in 1959 by Aaron Levine, a Philadelphia planner, which identified the Redevelopment Agency as one of the worst in the nation and recommended more leadership from the business community. The San Francisco Planning and Urban Renewal Association was born, funded by Blyth-Zellerbach, whose leaders included some corporations that still pay dues to SPUR, like Bechtel, Bank of America, Wells Fargo, and Pacific Gas and Electric Co.

John Elberling, a leader of the Tenants and Owners Development Corp., a group representing the people who were trying to stay in the area, was one of many activists who litigated against the city’s plan and managed to wedge some affordable housing into the developers’ vision of South of Market. SPUR, he told us, was "explicitly formed to support redevelopment issues in the ’60s and ’70s."

By 1974, when Paul began fending off redevelopment efforts around the Tenderloin and directed the North of Market Planning Coalition, "all through that period SPUR was viewed by the community as a tool for the Chamber of Commerce," he said.

In 1976, "Urban Renewal" became "Urban Research," a move away from the tarnished term. The 1999 commemoration of SPUR’s 40th anniversary is a somewhat sanitized history that never presents the faces of the people who were displaced by the program; nor does the analysis nod significantly toward the neighborhood groups and activists who were able to mitigate the wholesale razing of the area.

That’s still a soft spot for SPUR, some say. "They’re uncomfortable with questions of class. Those questions tend to be glossed over," said Tom Radulovich, executive director of Livable City and a SPUR board member from 2000 to 2004.

Metcalf doesn’t duck the issue. "If you’re a city planner, you’ve got to meditate deeply on urban renewal, even though you didn’t do it. It’s the only time in urban history that planners were given power, and that’s what they did with it," he said.

Besides a long friendship with powerful businesses, SPUR has frequently enjoyed an intimate relationship with city hall. "They morphed in the ’80s into a good-government, good-planning group, but in fact they were really tight with the [Dianne] Feinstein administration," Elberling said. "One of the ways you got to be a city commissioner was by being a member of SPUR. Feinstein’s planning and development club was SPUR."

Mayor Feinstein’s reign is often remembered as a boom in downtown development — at least until 1985, when San Franciscans for Reasonable Growth succeeded in passing Proposition M, a measure severely limiting annual high-rise development. SPUR opposed the measure and still supports increased height and density along transit corridors in the city.

"SPUR always goes with more," Radulovich said. "Sometimes there’s a trade-off between sustainability and growth, and I don’t have much confidence they won’t go with growth."

A March SPUR report, "Framing the Future of Downtown San Francisco," is one example of a cognizance of other options, weighing the pros and cons of expanding the central business district or transforming it into a "central social district": "While office uses remain, the goal of a CSD is to create a mixed-use, livable, 24-hour downtown neighborhood." Another line in the report offers a telling look at how SPUR thinks: "Economic growth in the CSD model may be diminished as the remaining sites for office buildings become used for new residential, retail, or other non-office uses."

Retail means, in fact, economic growth. A 1985 Guardian-commissioned study of small businesses in San Francisco, "The End of the High-Rise Jobs Myth," found that most of the new jobs created in the city between 1980 and 1984 were not in the downtown office high-rises but around them. Businesses with fewer than 99 employees had generated twice as many jobs as those with more employees.

While the numbers may be different today, the concept that neighborhood-serving retail keeps a local economy healthy has only grown stronger, as has public sentiment against chain stores. Yet SPUR opposed a proposition calling for conditional-use permits for formula retail, which voters approved in 2006.

Over the years SPUR’s political record has been checkered. Though the group talks the good-government talk, it opposed propositions establishing the city’s Ethics Commission and reforming the city’s Sunshine Ordinance. According to Charley Marsteller, a founder of Common Cause and a longtime good-government advocate in San Francisco, "Common Cause supported initiatives in 1995, 1997, 1999, 2000, 2002, and 2005. SPUR opposed all of them."

This November, SPUR came out in favor of Proposition C, which calls for public hearings before measures can be placed on the ballot, but opposed Question Time for the mayor. The group gave a yes to the wi-fi policy statement and approved establishing a small-business assistance center — contrary to past stances.

SPUR isn’t afraid to defend its positions. "Those who disagree with a conclusion SPUR reaches object to us presenting our ideas as objectively true rather than as values based," Metcalf notes in the May SPUR report "Civic Planning in America," in which he surveys other similar organizations.

"And in truth, evidence and research seldom point necessarily to one single policy outcome, except when viewed through the lens of values. We want to stop sprawl. We want housing to be more affordable. We want there to be prosperity that is widely shared…. Perhaps it’s time to grow more comfortable with using this language of values," he writes.

Paul, who’s now program director for the Haas Jr. Fund and has served on the SPUR board for seven years, says the group is indeed changing. "Over the last six to eight years I’ve noticed a real shift on the board," he said. "We have really intense and interesting discussions about issues. People feel they can speak their mind."

Okamoto, a partner in the Okamoto Saijo architectural firm, thinks this is the result of a fundamental shift in planning tactics, due to a more recent and deeper comprehension of the coming environmental crises. "Global climate change is moving things. I think SPUR’s going in the same direction," he said. Okamoto joined SPUR "because I’d like to see if I could influence the organization toward sustainability. Now we have a new funded staff position for that topic."

And yet the fact remains that only 5 of the 71 board members — about 7 percent — can be described as prominent progressives. At least half are directly connected to prominent downtown business interests.

And a list of SPUR’s donors is enough to give any progressive pause. Among the 12 biggest givers in 2006 are Lennar Corp., PG&E, Wells Fargo, Westfield/Forest City Development, Bechtel, Catellus, and Webcor.

In the past 10 years SPUR’s staff has doubled, signaling a subtle shift away from relying mainly on the research and work of board members. One of the newest positions is a transportation policy director, and that job has gone to Dave Snyder, who helped revive the San Francisco Bicycle Coalition in 1991, founded Livable City, and spent seven years on SPUR’s board before taking the job.

Having occupied the new post for a year, he said, "If I left, it wouldn’t be because I didn’t like SPUR. The debates we have at the staff level are more open than I expected."

Proposition A, the November transportation reform measure, is one example of the group’s new approach. The group voted a month earlier than usual to endorse a measure that was directly in opposition to the interests of one of its biggest funders, Gap billionaire Don Fisher (the Gap is also a member of SPUR). According to Walker, when the SPUR board vetted the endorsements the number of no votes for Prop. A was in the single digits. "I was so surprised," she said.

SPUR opposed Proposition H, a pro-parking countermeasure largely funded by Fisher, and worked with progressives on the campaign.

Metcalf noted it was the ground troops who made all the difference. "We don’t have [that kind of] power, and there are other groups that do. We wrote it, but we didn’t make it win. The bike coalition and [Service Employees International Union Local 1021] did," he said.

Sup. Aaron Peskin, who brokered much of the Prop. A deal, called it a sign of change for SPUR. "They probably lost a lot of their funders over this."

Radulovich is still dubious. He jumped ship after witnessing some disconnects between the board and its members. Though SPUR asks members to check their special interests at the door, Radulovich couldn’t say that always happened and recalled an example from an endorsement meeting at which a campaign consultant made an impassioned speech for the campaign on which he was working.

As far as his board membership was concerned, Radulovich said, "there were times I definitely felt like a token…. Development interests and wealthy people were much better represented."

Some say that isn’t about to change. "SPUR has been, is, and I guess always will be the rational front for developers," said Calvin Welch, a legendary San Francisco housing activist. "The members of SPUR are real estate lawyers, professional investors, and developers. Its original function was to be the Greek chorus for urban renewal and redevelopment."

Welch and Radulovich agree SPUR doesn’t represent San Franciscans, and Welch suggests the Dec. 4 Board of Supervisors hearing on an affordable-housing charter amendment was a case in point. "The people who got up to speak, I’d argue that’s San Francisco, and it doesn’t look a fucking thing like SPUR."

SPUR recently applied for a tax-exempt bond capped at $7 million from the California Municipal Finance Authority to help pay the cost of SPUR’s new Urban Center. It’s a standard loan for a nonprofit — SPUR is both a 501(c)(3) and 501(c)(4) — but some neighborhood activists raised questions about whether SPUR’s project is an appropriate expense for taxpayer cash.

"There’s no city money going toward the Urban Center, but by using tax-exempt bond financing they’re depriving the US Treasury of tax revenues," Salomon said. "The people who are funding SPUR can afford to buy them a really nice building, with cash."

The Urban Center also received a $231,000 federal earmark from Rep. Nancy Pelosi, whose nephew Laurence Pelosi is a former SPUR board member. Another $967,500 will come to SPUR from the California Cultural and Historical Endowment, which voters set aside through Proposition 40 to fund projects that "provide a thread of California’s cultural and historical resources."

Metcalf said SPUR isn’t sitting on a pile of cash: "We’re not that wealthy. We just don’t have that level of funding." The group’s endowment is small, and according to its 2006 annual report, revenues were $1.8 million, 90 percent of that from memberships and special events. The annual Silver Spur Awards, at which the group celebrates the work of local individuals, from Feinstein to Walter Shorenstein to Warren Hellman, is one of the biggest cash cows for SPUR, typically netting more than half a million dollars.

So far most of the funds for the Urban Center have come from donations raised from board members, individuals, businesses, and foundations. Metcalf defends the use of public funds. "For a group like SPUR that needs to be out in front on controversial issues, our work depends on having a diverse funding base. The Urban Center is part of that," he said.

The new headquarters is modeled on similar urban centers in Paris and New York, places that invite the public to view exhibits and get involved in answering some of the bigger planning questions cities are facing as populations increase and sprawl reigns. According to SPUR, this will be the first urban center west of Chicago, and the doors should open in 2009.

Walker, who’s been a board member for about a year, isn’t ready to say SPUR has been transformed. "It’s in my bones to be skeptical of SPUR," she said. "I have a different perspective than most of the people who are on SPUR, but the membership is different from the people who are funding it. I still think we need to have a more progressive policy think tank as well."

Walker recruits for SPUR’s membership development committee and said some of her suggestions have been well received. "The reality is, the progressive community is really powerful here when we come together and work on stuff. You can’t ignore us. Rather than fight about it, SPUR is offering some middle ground."

Presidio gets a Starbucks

GREEN CITY First came the troubling mandate that the Presidio needed to break even financially, a new model for a national park area. Then came the Starbucks. That’s right: the Guardian has learned that a Starbucks will open next month in the Presidio’s Letterman Digital Arts Center, replacing locally owned Perk Presidio.

The new Starbucks — and all it represents — has raised the ire of both park and city activists. Scott Silver, executive director of Wild Wilderness, based in Bend, Ore., is concerned that the Presidio’s self-funding requirement is a harbinger of things to come across federal land management agencies. He says other properties following the Presidio model include Fort Baker in Marin, Sandy Hook in New Jersey, Valles Caldera National Preserve in New Mexico (Forest Service land), and Fort Monroe in Virginia.

"It brings the entire standard of our national park system down from a high pedestal to a pretty base commercial reality," Silver said. "I just look at the Presidio as the first in what I fear will be a long chain of national parks that move away from the model of a publicly funded public good to a privately funded, largely commercial extension of our commercial world that’s really not in any way what we associate with national parks."

City activists point to Proposition G, which passed by a healthy 16 percent margin in 2006, requiring formula retail stores to get conditional use authorization from the Planning Commission before opening in neighborhood commercial districts. Richmond District residents demonstrated the power of this legislation in September by blocking a Starbucks slated for Fifth Avenue and Geary.

Dean Preston, a neighborhood activist and attorney launching a statewide organization called Tenants Together, said, "The law specifically applies to neighborhood commercial districts, but I think those same people who live in neighborhood commercial districts are using the Presidio, which is here in their backyard. I think that whether or not [Letterman Digital Arts] is subject to local law on the issue, they should be taking into account that city sentiment when deciding what kind of businesses to lease there."

Raul Saavedra, leasing director for Letterman Digital Arts, told us he didn’t know about Prop. G but that the company is aware that some people have opinions about Starbucks. That’s why the LDA originally selected Perk Presidio for the space. "We wanted someone like that to be successful," Saavedra said. "And they weren’t, unfortunately."

So the LDA decided to look for a new vendor, considering sole proprietors and local and national chains. Saavedra said the smaller operators he considered had credit issues and concerns about making the location successful. He said the key factors in selecting Starbucks were its strong credit, good service, and solid sustainability program.

Dana Polk, the Presidio Trust’s senior adviser for government and media relations, said that as master tenant, the LDA is free to sublet that space to any company it chooses. Nevertheless, Saavedra indicated that the LDA anticipated possible concerns with choosing Starbucks: "We went to the trust before we signed the deal with Starbucks, because we knew that there would probably be some opinions. And at that time there was no problem."

This will not be the first national park area to host a Starbucks. That dubious honor goes to the San Francisco Maritime National Historic Park, which since October 2004 has housed a Starbucks as a subtenant of Kimpton Resorts in its Hazlett Warehouse, according to Shelley Niedernhofer, chief of administration and business services for the park.

However, National Park Service concessions program specialist manager Jo Pendry confirms that these Starbucks are the first examples of formula retail throughout the 391-site national park system.

Kim Winston, Starbucks manager of civic and community affairs for the western region, claimed that revenues from the Starbucks help fund National Parks Service operations, but Niedernhofer said of the Maritime Park, "We don’t receive any revenue directly from Starbucks." The Presidio arrangement will be similar.

But Preston isn’t mollified. He said, "To have a Starbucks go into the Presidio with no real public review right after a Starbucks is nearly unanimously blocked [by a Board of Supervisors’ vote] in the Inner Richmond does seem like a real contrast. The fact that there’s absolutely no public process for putting a Starbucks in such a visible spot is really a problem." *

Backpedaling

Environmental studies on the San Francisco Bicycle Plan have been delayed for almost a year, pushing back the city’s earliest opportunity to lift a court-imposed injunction against improvements to the system — covering everything mentioned in the plan, from new bike lanes to simple sidewalk racks — to summer 2009.

Bicycle advocates and some members of the Board of Supervisors are calling the bureaucratic delays unacceptable, and they’re actively exploring ways to speed things up. Frustrations are running so high that some activists are now talking about taking the plan directly to voters, noting that initiatives are generally exempt from the strictures of the California Environmental Quality Act, under which the bike plan was successfully challenged last year by antibike activist and blogger Rob Anderson.

"We’re looking at creative strategies to make this move, because the plan the city has now is unacceptable," Leah Shahum, executive director of the San Francisco Bicycle Coalition, told the Guardian.

Shahum wouldn’t specifically address the idea of an initiative, which was a hot topic among transportation activists at the monthly Car Free Happy Hour on Dec. 5, but sources say it’s being given serious consideration. One proposal would wrap the bike plan into an omnibus climate change ballot measure promoting alternatives to the automobile.

Earlier this year staffers at the Metropolitan Transportation Agency and other city agencies involved with the bike plan said the draft environmental impact report would be ready by next month (see "Stationary Biking," 5/16/07), but in recent weeks they’ve pushed that target back to September 2008. They’ve also extended the time for follow-up work after the DEIR is complete, now projecting final EIR adoption in late spring 2009 rather than June 2008, as originally envisioned.

When the MTA board was asked to approve the delay Dec. 4, the members were presented with a staff report indicating the "original" estimate for the DEIR was June 2008, "a shift of three months," as MTA spokesperson Kristen Holland also emphasized in an e-mail responding to questions from the Guardian.

But in reality, the target date has been pushed steadily backward by staff at regular intervals throughout the year. When consultant Wilbur Smith Associates began work in May and a public scoping meeting was held, the January DEIR deadline (which had already quietly been moved back to Feb. 1) was moved to June 7. Then to July. And now to September or perhaps even mid-October 2008, as the consultant’s Dec. 3 timeline showed.

"The mayor did not seek to slow it down. What in fact happened is that — much to our disappointment — several city departments told us that our aggressive June 2008 goal could not be met chiefly due to the EIR’s expanded scope," Nathan Ballard, press secretary for Mayor Gavin Newsom, told the Guardian.

After the final EIR is approved in 2009 and the Bike Plan is readopted by the Board of Supervisors, to lift the injunction city attorneys must return to Superior Court Judge Peter Busch (who ruled last year that the plan’s original EIR didn’t comply with CEQA), persuade him to lift the injunction, and hope that Anderson attorney Mary Miles (who is asking the city to pay almost $1 million in legal fees to which Busch says she’s entitled, although the city is contesting the amount) can’t force more delays.

"At this rate the City will be prohibited from making bicycle route and parking improvements until at least mid-2009, and it’s quite likely that the City won’t be back to striping bike lanes until sometime in 2010. Four years of zero bike lanes, four years of zero bike racks, an entire San Francisco mayor’s term," SFBC program director Andy Thornley wrote in a Nov. 27 letter to Newsom on behalf of the SFBC calling on the mayor to help accelerate the schedule.

Ballard said Newsom is trying: "Our office has asked the departments to identify both opportunities to expedite certain phases of the project and additional impediments to meeting the current timeframe."

Sup. Bevan Dufty, who chairs the Transportation Authority’s Plans and Programs Committee, is also pushing for a faster turnaround. He brokered and attended a Dec. 7 meeting involving Shahum and Planning Director Dean Macris.

"I think [Macris] had some excellent ideas about bringing on some consulting staff to help work through the process…. I think in another week we’ll have some solid announcements," Dufty told the Guardian after the meeting. "He felt the department could do more and do better."

Sup. Ross Mirkarimi, who is talking with activists about a possible ballot measure, also expressed frustration, blaming "antibike forces in the Newsom administration" and pledging to keep the pressure on. He told us, "There’s no reasonable justification that would delay this into 2009."

But project staffers say their work is both complicated and unprecedented. "No one has ever done an environmental review quite like this," Oliver Gajda, bicycle program manager for the MTA, told the Guardian. "It’s a fairly complex document that no city has done."

That’s because San Francisco’s bicycle plan is the first to be successfully challenged under CEQA. Gajda said the latest delays stem from expansion of the work scope and from in coordinating with various neighborhood plans in the city and with other agencies like the port and redevelopment districts.

"We’re trying to capture everything we can foresee in the entire city," Gajda said. "We are trying to make this the most solid environmental document possible."

That’s understandable from the perspective of planners whose initial stab at the plan was rejected by the courts, but activists say four years is too long to wait for improvements to a bicycle system that has seen a 12 percent increase in the number of bicyclists on San Francisco streets in the past year, according to an MTA study.

"The fact that this critical project has drifted so far off track in a green city indicates a disappointing lack of commitment from city agencies and no strong hand to guide the Bike Plan forward in a timely fashion," Thornley said. "It’s time for real action and a real commitment from the city to get this work done so we can return to putting real bicycle improvements on the streets of San Francisco."

Luz Moran, 75, fingers through a shoebox full of certified envelopes from her landlord’s attorney, squinting at the English words. She’s sitting on a red couch in the living room of her modest Mission District apartment, her feet barely touching the floor.

"This is another check he sent me, look," she mutters in Spanish, pointing out two checks amounting to $3,752.85. The money was sent along with an Ellis Act eviction notice, the first half of the $7,500 in relocation benefits city law requires be given to elderly or disabled tenants who are removed through the state law (if the tenant is not elderly or disabled, the landlord only needs to provide them with $4,500).

"I don’t know what we will do. Other apartments are expensive, and we can’t afford them," Moran says. The money is barely enough to cover moving costs and the first month’s rent at another place, she says, adding, "I don’t think this landlord is dying because of lack of money."

The eviction was not her landlord’s first attempt to move Moran, along with her 92-year-old mother and her son, from their two-bedroom apartment. In May 2006 he offered to sell them the unit for a discounted rate of $310,000, which was out of the family’s price range. Then he suggested a buyout agreement so they would leave voluntarily, but said he couldn’t offer much more than the Ellis Act’s required compensation. After the initial attempt to subdivide the building and all other negotiations failed, the landlord finally issued the eviction. He now wants to sell the units as tenancy in common apartments. But the Morans — and some other tenants in the building — are refusing to cash his checks.

"Because if we accept the money, it says that we are willing to leave here," Moran says.

The word eviction brings back bad memories for many residents of San Francisco, where the number of people thrown out of their homes numbered 2,878 in 1999. Then, at the height of the dot-com era, long-term renters were booted to make room for higher-paying tenants and out-of-towners prepared to buy six-figure homes.

But Moran’s story highlights two new additions to the renter woes that fill the San Francisco Tenants Union these days: landlord buyouts and a surge in TIC homeownership. With San Francisco’s housing prices on a seemingly perpetual upswing, it’s no wonder TIC ownership has increased twelvefold in the past decade. In 1996, 55 TIC units were sold through the San Francisco Multiple Listing Service, and in 2006 that number rose to 650, according to Realtor groups.

At first glance, it looks as if this trend should answer the prayers of middle-class families while avoiding an increase in no-fault tenant evictions. The city’s total evictions have been going down since 2001, hovering around 1,500 since 2003. But over the past five years Ellis Act petitions have slowly picked up, then petered off again, according to Rent Board data. And Ted Gullicksen, office coordinator at the Tenants Union, says these numbers don’t take into account relocation as a result of unregistered buyouts and threats, which can often lead to TIC ownership.

Each weekday at the Tenants Union dozens of renters shuffle through the doors, plop into mismatched chairs, and wait for hours to spill their complaints and legal paperwork onto the desk of a volunteer counselor.

"We’re pretty busy here at the Tenants Union," Gullicksen says on a Friday afternoon during counseling hours. "It’s pretty close to what it was during the worst of the dot-com years."

Gullicksen reports an increase in the number of threats and buyouts of tenants in the past year. He attributes that to 2006 legislation passed by the San Francisco Board of Supervisors prohibiting the conversion of buildings after the eviction of elderly or disabled tenants or multiple units. By avoiding putting an Ellis Act or other no-fault eviction on the record, the landlord can eventually convert the building into a condominium because its history hasn’t been tainted.

A building with no eviction history goes for more on the MLS, according to Gullicksen, which explains why landlords are willing to pay up to $60,000 for a "voluntary" tenant relocation. The private landlord-tenant agreement may be lucrative to the individuals involved, but it results in an almost undetectable loss of an affordable rental unit.

Gullicksen says it’s impossible to determine how many tenants relocate due to buyouts on a citywide level, but about 60 people seek help with one at the Tenants Union every month. Most tell a similar tale: A developer or landlord will offer between $2,000 and $60,000 to tenants to voluntarily vacate. The tenant may ask for a higher sum, and they’ll negotiate back and forth. Eventually, the tenant may be either bought out or evicted.

"It’s a game of chicken, really," Gullicksen says.

The loss of rental units at the hands of TICs or buyouts is not a small matter in a city where two-thirds of residents are renters (on the national level only 34 percent of housing units were rentals in the year 2000), and there is already a shortage of affordable housing.

US Census data show that San Francisco lost 18,474 rental-occupied housing units between 2000 and 2006. And the city isn’t doing much to plug the drain. According to the Planning Department, 13,795 new units have been built and ready for occupancy since 2000, and approximately 12,600 of those are condominiums.

Although the terms "TIC" and "condo" are often used interchangeably, they’re legally different. TICs follow a shared-homeownership model involving one deed and multiple live-in shareholders. They aren’t registered or restricted by the city, whereas condominium conversions are capped at 200 a year. Most notable is the price differential: TICs go for about $200,000 less than a median-priced condominium in San Francisco, which currently runs at $783,000, according to the San Francisco Association of Realtors.

TIC owners typically buy in hoping to raise their property’s value by eventually converting their units to condos through the city’s lottery system. Proponents call TICs one of the city’s only affordable homeownership options. Critics call them a loophole in condo conversion restriction laws.

Radhi Ahern, managing partner and broker at the TIC Group, doesn’t apologize for buyouts to make room for TICs. She acknowledges that TICs are obtained through financial negotiations with tenants.

"It’s the tenant’s choice on whether they get a buyout or don’t take a buyout. And it’s sometimes very lucrative," Ahern says from her spacious Union Street office. "I can honestly say nobody’s given me $25,000 to $50,000 to move into a place…. It’s a win-win situation."

A number of recent changes have increased TICs’ popularity, Ahern says. At first they were financially risky — with multiple people on one mortgage, everyone is affected if one defaults. But in recent years banks have taken on more responsibility through individualized loans to TIC owners. Ahern adds that there are virtually no foreclosures on TICs.

"With the advent of fractional financing, we’re going to see more and more people adopting TICs, just like co-ops were adopted in NYC," Ahern says.

In a city where about 90 percent of residents can’t afford a median-priced home, TICs are lifesavers to people like Scott Ozawa. The recently divorced 31-year-old father of two toddlers makes six figures at a dot-com but says buying into a Western Addition TIC was the only way he could own the home he wanted in San Francisco. Evictions shouldn’t be blamed on TIC owners, he says, but on the city’s faulty housing system and lack of new development.

"The lower-income and the middle-income folks are all vying for the same resources," Ozawa says. "But middle-income folks have more options that are open to them."

Meanwhile, Moran and her family plan to stay in the rent-controlled apartment she has lived in for 35 years and might have to fight an unlawful-detainer order in court this month. She says she likes her place — the neighbors all know one another, she’s close to transit, and her apartment’s thick walls offer protection from earthquakes. The family pays only $507 per month, less than one-fifth the average rate for a two-bedroom apartment in San Francisco, according to the Tenants Union.

In September the Morans and other tenants at their apartment held a support rally outside their building, catering it with sandwiches and juice they prepared. Four elderly female tenants lined up on the front steps, taking turns speaking to the few dozen onlookers. Moran’s upstairs neighbor took out her oxygen tube to speak into a bullhorn. Moran stood beside her, later clapping along to a guitar-strumming activist singing, "Yuppie, yuppie stole my pad! Yuppie, yuppie, bad, bad, bad." As she smiled and mouthed the words in a language she doesn’t speak, a young couple wearing bandannas and carrying what looked like art supplies exited the building next door. They glanced toward the crowd with confused, down-turned brows but didn’t break their stride as they walked off the steps in the opposite direction.

Housing reform, now

OPINION The Board of Supervisors is poised to vote on a crucial charter amendment to set aside more than $30 million per year for new housing. Since the mayor is talking about a huge budget crisis and a lot of people may complain that more funding for affordable housing will make the flow of red ink worse, it’s important to understand what this issue is all about.

While many of us are aware of the exodus of working-class people, most San Franciscans are unaware that the city is in the final stages of the largest rezoning effort of the past 50 years. The Eastern Neighborhoods plans will set new land-use rules for the Mission District, eastern SoMa, Potrero, the Central Waterfront, and parts of Bayview.

Those areas are going to be opened up to vast new developments, including as many as 20,000 new housing units and tens of thousands of square feet of new commercial development. I can think of no greater opportunity — nor any greater potential disaster — than the Eastern Neighborhoods rezoning effort.

Opening up the Eastern Neighborhoods for new housing without a commitment from the city to provide more resources for affordable units will guarantee that the new neighborhoods will exclude working-class residents and exacerbate the affordable-housing crisis in San Francisco for years to come.

In the Mission and many other districts, despite the cry for more affordable housing, the city has not prioritized housing for working-class San Franciscans. We hear a lot of talk from city hall, but in reality most of the new housing that gets built is far too expensive for most residents. This is a huge crisis — and the charter amendment will finally give affordable housing its rightful attention from the city.

We can’t accept a plan that relies only on the market to produce and fund some affordable housing. We’ve seen what that means: for more than seven years, while the community has waited for the Eastern Neighborhoods plans to be completed, housing for the wealthy has been built and housing for everyone else has been an afterthought. The Board of Supervisors has set an ambitious goal — 60 percent of all new housing should be below market rate — but the Planning Department and the Mayor’s Office of Housing have failed to produce a comprehensive strategy to meet that target.

So despite the budget crisis, the timing of the Affordable Housing Charter Amendment could not be any better. A measure that designates a significant amount of money every year for housing for working-class San Franciscans can finally bring accountability and a commitment from the city to build and retain affordable housing and plan for inclusive new neighborhoods.

We can’t sit idly by while the disparities widen between rich and poor, whites and people of color — or we will wake up 15 years from now and see the result, the continued exodus of working-class families and other lower-income communities. San Francisco is the only city I know of whose Latino population is stagnant and whose African American population is declining. The time to act is now. The Board of Supervisors should approve the Affordable Housing Charter Amendment, making it one of the key issues in 2008 for San Franciscan progressives.

Some hope for the UC site

EDITORIAL State senator Carole Migden has stepped into the battle over a 440-unit housing development on the old University of California Extension site, and that creates some promise that the project can be taken off the fast track. State intervention may be critical; the university, which has a record of ignoring local land-use policies, wants developer A.F. Evans to get the project moving forward by the end of 2007, which has driven the San Francisco Planning Commission to schedule a Dec. 20 decision on the project’s environmental impact report. Migden, who isn’t afraid to play hardball, is contacting university officials to let them know she wants the EIR and the project approval delayed until city officials can negotiate a better deal for affordable housing.

Meanwhile, Sup. Ross Mirkarimi is demanding that the developer double the amount of below-market housing.

Mirkarimi and Migden are absolutely right here: the project site is public land that’s being turned over to a private developer for private use — and the city could be getting a much better deal. Evans is offering to set aside just 20 percent of the units for people who aren’t rich — and that’s nowhere near enough to justify turning over public land. Part of the fault lies with the UC, which wants Evans to pay a stiff fee for the use of the land; that’s something Migden ought to press university officials to reconsider.

In the meantime, the Planning Commission should take the EIR off the December calendar and give everyone involved some more time to negotiate.

Spending time with your family over the holidays can be difficult. Are you a vegetarian atheist with carnivorous, God-fearin’ folks? Are your grandparents racist? Then you know what I mean. But these special occasions don’t have to suck. Step one? Stop playing on their turf. Why spend one more holiday giving them the home-team advantage, biting your tongue to make them feel more comfortable? Instead, tell your relatives to get their asses up to San Francisco for a good old heathen’s ball. It may sound counterintuitive, but think about it for a minute: you’ll be in charge. It’s the perfect time to have the holiday you’ve always wished you’d had … or to just get even with your folks for all of those miserable dinners you’ve gritted your teeth through all of these years. The businesses listed below have everything you’ll need to either gently ruffle some feathers or send your folks screaming back to their safety nooks. How far you choose to take things is up to you — and your childhood trauma.

DECK THE HALLS WITH PAGAN ALTARS


If your parents’ wholesome holiday decorations are inherently offensive (even the average gender-"appropriate" angel ornament can seem oppressive to a student of gender-continuum philosophy), you can beat them at their own game by picking up a few things at Under One Roof (549 Castro, SF; 415-503-2300, www.underoneroof.org) in the Castro. Most of the holiday knickknacks you’ll find there, like rainbow-cloaked Santa Claus decorations and muscle-man bottle openers, will do little more than raise a conservative’s eyebrow. But they’ll provide valuable ammunition when the conversation turns political: just watch how Dad reacts when you counter his homophobia by pointing out that the cocoa mug he’s using comes from a boy-town volunteer organization that donates all of its proceeds to HIV-AIDS research.

If that doesn’t work, try riling your folks by jabbing at their spirituality with holiday decorations. They force you to stare down Christianity at every turn? Then shove your lack of belief down their throats this year by shopping in the Mission, where a cluster of small boutiques carries everything you’ll need for an offbeat — or damn near demonic — holiday party.

Start your spree at Paxton Gate (824 Valencia, SF; 415-824-1872, www.paxtongate.com), where you’ll find an assortment of unconventional home decor options, including carnivorous plants and a large collection of vaguely satanic household accessories. Although you might score some unwanted points with your hunting-aficionado brother with a few of taxidermist Jeanie M’s dangling mice angels, you’ll certainly lose plenty from your born-again aunt, whose collection of gruesome Jesus-dying-on-the-cross sculptures offend you as much as your ornaments will her.

After grabbing some choice roadkill art, you’ll want to head to Yoruba Botanica (998 Valencia, SF; 415-826-4967) for some Santeria-style pagan altars, spell candles, and heretical oils and scents, then to Casa Bonampak (3331 24th St., SF; 415-642-4079, www.casabonampak.com) for some Latin flair. A wreath made of chile peppers, some Virgin of Guadalupe party streamers, and a few discounted Día de los Muertos items will add a little subversive color to your thoroughly confusing collection of holiday decorations.

If you’ve lived in the city for more than two years, you’ve probably adopted a cruelty-free diet and grown weary of your family’s annual flesh-eating parties. You know those relatives who always "forget" you don’t eat meat? Now you can ostracize them by serving an alternative smorgasbord from SF’s premier food co-op, Rainbow Grocery (1745 Folsom, SF; 415-863-0620, www.rainbowgrocery.org). There’s plenty to choose from here, including a full line of Tofurky products, organic cranberry sauce, and Tofutti brand frozen treats for dessert.

With dinner out of the way, it’s time to expose your family to a bit of real SF culture with some quality time for them and your friends. You’ll want to invite an array of typical weirdos to rival your family’s usual assortment of nerdy cousins, creepy aunts and uncles, and stoic grandparents; we suggest at least one hippie, a lesbian couple, a club kid, and a few snobby hipsters with neck tattoos.

If none of your friends are willing to flaunt their earlobe plugs or perform a contact improv dance number, you might want to put some effort into background noise. Downloading a raunchy playlist will work in a pinch, but if you really want to shock your guests, how about visiting Amoeba Music (1855 Haight, SF; 415-831-1200, www.amoeba.com), which carries almost every holiday album ever made? Start with Run DMC’s single "Christmas in Hollis" (Fedor Sigel, 1987), then move on to something more unsettling, like the heavy metal compilation A Brutal Christmas: The Season in Chaos (SoTD Records, 2003). You can still torture your folks with shots of Fernet back at your apartment as punishment for all of the fattening eggnog nightcaps you’ve endured over the years, but if you ever want to see them again, you might just lead them to their half-deflated air mattresses and bid them good night. After eight full hours of tossing and turning on your floor, maybe they’ll be inspired to tone it down next time you come to visit — or at least remember to add a plate of steamed vegetables to the slaughtered-animal spread. And if they’re not, you can always bring a penis cake home with you next year. *

My favorite thing about a good gift is that it means something: it’s an expression of how I feel about you (or vice versa), what I appreciate about you, and the fact that I not only know you well enough to know what you like but also love you enough to want you to be happy.

A store-bought gift is capable of achieving all of these lofty goals, of course. For example, my sister recently gave me a copy of Beatallica (Oglio, 2007) she found while on tour with her band. And though seemingly small, this simple choice communicated these things: (1) My sis was thinking of me while in Denver. (2) She knows me well enough to remember I love (and I mean love) novelty rock. And (3) she cares about me enough to want me to feel joy.

But just like your mom told you when you were a kid (though she might’ve been lying about the ceramic ashtray), some of the best gifts are homemade. And they’re also the kind that are as much fun to make as they are to give. Case in point? The family-centric version of People magazine (complete with crossword, horoscope, and They’re Just Like Us! sections) my sis and I made for our pop culture junkie mom a few years ago. Not only did it mean more to Mom than yet another funky wineglass, but Sis and I also had a blast putting it together.

Problem is, how do you come up with a project that’s personal, doable, and original? (After all, how many decorated bowls from Terra Mia can you give someone?) Sure, you could invent something brand-new that’ll take you months to perfect and even longer to complete (hello, custom book I decided to make as a gift one Christmas and didn’t finish until the following Christmas). Or you can take the advice of crafty vixen (and personal chef) Larisa Chapman, who’s already figured out how to make this foolproof, flawless gift:

Miniature Altar

WHAT YOU’LL NEED


Altoid (or other) tins or boxes (smaller boxes are easier to work with)

Modge Podge (which now comes in sparkly and iridescent versions) or any polymer glue

Images from magazines, postcards, graphic novels, books, etc.

Good scissors

Small paint brush (for glue)

Jewels, beads, trinkets, ribbons, shells, other small decorative items

Small birthday candles

Blow-dryer (optional)

HOW TO PROCEED


Step One: Planning

The idea is simple: a small, cheap, fun, completely customizable art piece that can be either displayed open or kept as a small treasure trove — that’s up to you and the altar’s recipient. Most important, though, it’s something made specifically for someone. So your first step is to decide whom you’re making your altar for and what you want to communicate to them. This can be as simple as a rock ‘n’ roll theme for your musician sister (ahem) or as complex as references to the symbolism of the phoenix for a friend who’s trying to rise above a challenge. Chapman likes allegories, stories, and contradictory images — think Tarot card collages or an image of the Virgin of Guadalupe with a halo of porn — but you should figure out what appeals to you and the person who’ll receive the gift.

Step Two: Assemblage

What happens next is mostly up to you. Paste images to the top, bottom, and inside of the box (Modge Podge is fantastic as both an adhesive and a sealant, so don’t be afraid to use it for everything). Add fabric lining, beaded details, glitter, 3-D objects … whatever suits your fancy. And don’t be afraid of overadornment — think Mexican saint altars.

Step Three: Drying

More complicated altars may require several layers of assemblage, and therefore might need drying time between layers. Set the box in a well-ventilated area until the glue is dry to the touch. Or, to speed up the process, take a blow-dryer to the glue. When it turns clear, it’s done.

Step Four: Meaning

The last step is adding a candle. The easiest way to do this is to choose a bead or other object that can comfortably fit a birthday candle inside. Attach the bead to the box and the candle to the bead. Now you have an object that looks as sacred as it actually is. (Don’t forget to remind your giftee not to light the candle, as that will make your whole altar will go up in flames. Unless, of course, they’re into that.)

See? Simple. Cool. Fast. Now rinse and repeat. The more you do it, the easier it’ll get — and the more elaborate. Experiment with bigger boxes or containers of different shapes. Get creative with puffy paint or stencils. Use fun fur or punk rock patches to turn your friend’s whole automobile into an altar. (OK, maybe you should ask before you do that one.) No matter what you come up with, it’ll sure beat a gift certificate for Best Buy.

Art and History vie for Presidio spot

Last night at the Officer’s Club about 200 Marina residents gushed over Gap-founder Don Fisher’s plan to put a 100,000 square foot museum in the Presidio to house his art collection. For the most part they gave a demur nod to the Presidio Historical Association’s alternate proposal for a history museum. The two museums are vying for the same slice of real estate at the head of the Main Parade Ground, facing north toward the Bay where a bowling alley and tennis courts are currently located.

The historical association made a case for the site as a place where the history they’d be presenting actually went down, and said the grounds surrounding the museum would be a part of the museum itself. “The Main Post area is the most historically sensitive area,” said Gary Widman of the Historical Association. “It’s where San Francisco really started 1n 1776 and it’s an area that has buildings from almost every major period since that time.”

The only historical connection Mr. Fisher could come up with was the original plan for the Main Parade Ground, which called for a significant building at its head to anchor the site. He was firm in saying he could think of no other possible place for his museum. “This is the only location that works for us,” he said. “Nothing like that is available anywhere else in the Presidio.” In fact, he said he was planning on gifting his art to some other, already established museums until he was approached by the Presidio Trust, which suggested he consider building his own museum in the park instead.

Before the two plans were presented, Mayor Newsom offered some very diplomatic remarks suggesting a great compromise. “These don’t have to be competing projects,” he said, adding that he’d appointed a staff member (Kyri McClellan, 554-6123) to this project. “My office wants to participate in this process from the beginning.”

The plans agreed on one issue — parking would go underground. After that, they differ radically.

There’s a new mural at 24th and Capp streets that does a stellar job of capturing the urban, cultural vibe of the Mission’s residents. No, not the skinny jeans–wearing, Burning Man bohemians who’ve colonized the area in recent years. I’m talking the baggy jeans–wearing Latino youths who are the inheritors of a proud local tradition of Chicano mural art. Craftily melding urban motifs, the mural celebrates their bicultural realities: lowriders cruise alongside hyphy "scrapers," pachucos and Mac Dre mingle, and graffiti lettering makes the same statement as silk-screened Brown Pride posters of the ’70s.

The work was created from July to September by members of Homies Organizing the Mission to Empower Youth, a neighborhood-based youth leadership nonprofit serving at-risk Latino teens and young adults. The primary goal of HOMEY is violence prevention. Through art, education, and skill-building activities, the organization offers alternatives to young people growing up in a rough environment where gangbanging, drug dealing, gun violence, and incarceration are the norm.

The mural is a shining example of the numerous creative projects initiated by HOMEY to bring together young folks who might otherwise have beef or get caught up in the neighborhood’s dangerous Sureño-Norteño turf rivalry. According to HOMEY project coordinator Nancy Hernandez, the mural bolstered the organization’s other violence-prevention efforts because "young people who didn’t know each other got to know each other. People in the community who didn’t know each other got to know each other. And people were educated on a lot of things to be proud of about their culture, their history, and their neighborhood." Although a core group of teen and adult artists executed the initial planning and design for the mural, in the end more than 200 community members contributed to the painting.

The title of the piece is Solidarity: Breaking Down Barriers. Taking unity as a starting point, the artists began by brainstorming about the influences that divide people, communities, and cultures: everything from national boundaries to gang-affiliated colors. No national flags appear in the 100-foot-long painting. The United States–Mexico border wall figures prominently, snaking through the background of the mural’s central panels, but it’s juxtaposed with portrayals of intra- and interethnic alliance in the foreground. Mexican Revolucionarios, members of the United Farm Workers, and Brown Berets, all painted in sepia tones, float beneficently behind modern-day Raza activists wearing white tees and white bandanas — a purposefully neutral color worn nationwide by Latino youths during the immigrant rights rallies of May 1. In the Bay Area, many of those activists were HOMEY members.

As celebratory as the painting is, one controversial panel on its far right-hand side threatened to overshadow the entire project. It’s a portrayal of Palestinians garbed in traditional Arab kaffiyeh head scarves breaking through a concrete wall — ostensibly the Israeli West Bank security barrier. The image fits into a third-world rights vignette expressing solidarity with indigenous groups and colonized peoples.

Some members of San Francisco’s Jewish community took issue with the image, which originally included a hole in the wall in the shape of the state of Israel. Two Jewish advocacy groups, the Jewish Community Relations Council and the Anti-Defamation League, brought these concerns to the San Francisco Arts Commission, the board charged with approving all public art. "We thought this one panel was disjointed from the rest of the mural," JCRC associate director Abby Michelson Porth recalls telling HOMEY and the Arts Commission at a public forum this August. "It didn’t demonstrate peaceful coexistence, which is, frankly, contrary to the theme of the work."

Rather than battle it out and fling loaded accusations of censorship and anti-Zionism at each other — which would indeed completely contradict the intent of the community-building project — the two factions engaged in a civil dialogue that turned out to be a learning experience for all. HOMEY agreed to make some changes to the imagery: the kaffiyeh shrouding one figure’s face, which the JCRC and the ADL claimed connoted terrorism, is now pulled back and worn as a simple Muslim head scarf; the wall opening now breaks into an expansive blue sky; and the branches of an olive tree now weave around the wall — a symbol of peace and a near-literal olive branch. Still, according to Porth, "It’s not the imagery that we would choose, but we recognize the muralists made significant changes and that they came far from the original design."

Hernandez is quick to point out that many Jewish San Franciscans supported the original design and that several of the artists are in fact Jewish. But she acknowledges that "when we’re painting somebody else’s culture, we have to be humble. We have to say, ‘You know what? We don’t know everything about everybody, but we do know about ourselves, and we’re trying to draw parallels between ourselves and other peoples.’<0x2009>"

To many, it may come as a surprise that the mural’s Palestinian imagery was so controversial. After all, claiming solidarity with Palestine is a common stance among San Francisco’s radical left. Nonetheless, by giving their input, the mural’s detractors wound up being collaborators on a project authored by, as it turned out, truly disparate voices in the community.

The proposed Central Subway project has arrived at a critical point in its planning stage, with the public comment period for its environmental documents coming to a close Dec. 10 after a series of recent workshops and meetings.

Proponents see the project as an important next stage of the Third Street Light Rail Project and a vital link to Chinatown, which was made less accessible when the Embarcadero Freeway was torn down. But even some transit advocates question whether the project, with a price tag of $1.2–$1.7 billion, has enough bang for the buck to be worth it.

The Central Subway would realize the San Francisco Municipal Transportation Agency’s long-standing vision for a subway system that links to the northeast sector of the city, alleviates traffic problems, and improves connections with BART and Caltrain.

This phase of the project, which proposes to connect the South of Market area to Chinatown by underground rail by 2016, has received the fiscal green light — $1.2 billion in state and federal funding is already pledged.

Board of Supervisors president Aaron Peskin, whose District 3 includes Chinatown, called the Central Subway "a very good and wise investment in San Francisco.

"Any investment in public transportation is a good thing," he added. "Is it expensive? Yes. But so were" many other transit projects.

Rose Pak of the Chinese Chamber of Commerce, an influential force in San Francisco politics, insists that the Central Subway project is imperative to the Chinatown community.

"It’s long overdue," she told the Guardian. "Over 70 percent of our people rely exclusively on public transit. It’s very important to them. They don’t own cars, but they still need to get here for work, to see friends and family."

But is a 1.7-mile stretch of subway the right priority for and the right way to spend San Francisco’s scarce transportation money? Tom Radulovich, elected BART board member and executive director of Livable City, said making the Central Subway a top priority is a "big mistake."

"If everything else was well with Muni, this might be a good project," he told us. "But we need to take care of first things first."

Radulovich emphasized that improving the existing Muni service is a better step toward resolving San Francisco’s transit problems. He pointed out that using state and federal government money for other projects would go a lot further in improving the overall system. He said the Central Subway project is prematurely being made a priority.

"It’s like trying to build a master bedroom suite on top of a foundation that needs reinforcement. It’s nice, but it doesn’t make much sense," he said.

When asked about the possibility of revamping the Muni bus lines that presently serve Chinatown, Pak explained that the existing bus service already functions at capacity.

"Stockton is one of the busiest streets in San Francisco," she said. "Have you ever tried to ride a bus there at rush hour? It’s almost impossible."

In fact, the project’s Supplemental Environment Impact Report states that bus service already runs at three-minute frequencies or better for most of the Central Subway corridor. It also affirms that the area is operating at capacity, "particularly Stockton Street."

Pak added that the Central Subway would allow for shorter transit times and a "minimum disruption of surface streets."

After the Embarcadero Freeway was disabled by the 1989 Loma Prieta earthquake, the decision was made to remove and not replace it. That angered many Chinatown merchants, who became the base of support for the Central Subway project.

At first the group "didn’t have the muscle nor the power," Pak told us. "But our community rallied. We did massive letter writing and postcard writing."

Now challenging the project or raising concerns about its cost or feasibility — which some critics and media reports have done — means doing battle with Pak and the Chinese American community, a substantial voting block. So Mayor Gavin Newsom, Sup. Peskin, and other top elected officials support the project.

At the San Francisco Planning Commission meeting held Nov. 15, David Chiu, a commissioner on the Small Business Commission (and candidate to succeed Peskin as District 3 supervisor), said he was "really looking forward to this project moving forward" but would like to see more detail in the SEIR about the process for relocating small businesses.

Commissioner Michael Antonini "strongly advised" extending the subway as soon as possible to North Beach and Fisherman’s Wharf and all the way to the Richmond, arguing the current terminus in Chinatown doesn’t make long-term sense. But few at the hearing argued the project shouldn’t be built.

According to the SEIR, traveling from Fourth Street and King to Chinatown on the Central Subway would cut up to 12.4 minutes from the journey in 2030 — from the bus time projection of 17 minutes to less than five minutes in one subway alignment alternative.

Four "Alignment Alternatives," or designs for how the subway will be built, are laid out in the SEIR, which was released for public review Oct. 17 and made the subject of three community workshops and a Planning Commission hearing.

Options range from enhanced bus service and no subway to one that includes some surface rail along Fourth Street (with a new station at Moscone Center) to an option with more of the route underground and Chinatown stations in various spots.

Once an alignment plan is chosen, the SFMTA will vote on the final design next year. And if things go smoothly, construction on the project could start in 2010 and service begin in 2016.

Housing: the urbanist approach

OPINION We’re in a tough spot as a city when it comes to housing costs. As the price of living here goes ever higher, we lose everything special about the culture of San Francisco.

Here’s the dilemma: more people want to live here than we are creating places for.

Why do people want to live here? Cultural tolerance. Economic opportunity. To be part of a community that doesn’t feel like the rest of the United States. The same mix of reasons that caused most of us to come here.

But we are barely adding to the supply of housing. On average over the past two decades, we have produced around 1,500 units per year. The city would need to produce between 3,000 and 5,000 units per year to keep housing costs from going up. If we added 5,000 units a year, after 70 years we would have the same density as Paris.

We already know what happens when people in a city faced with high housing demand decide they like their community the way it is and do not allow new construction. You get Carmel and Colorado’s Aspen and Boulder. You get an ultraritzy resort town.

San Francisco is on the way to becoming the largest city to go down this path.

The easy answer is to blame gentrification on the high-rise condos for rich people. But the only thing that would gentrify the city faster than building those condos is not building them.

People are moving here. If they are not allowed to be stacked in little concrete boxes on top of other little concrete boxes, those with more money will displace those with less money, through the simple process of being willing to pay more for the Victorians and all the rest of the building stock. That’s why older housing units don’t sell for less than new housing units.

What do we need to do? Increase housing at all levels, but in a smart way:

Concentrate the housing in places with excellent transit and within walking distance of stores.

Add as much to the supply of affordable housing as possible. This costs about $200,000 per unit in subsidy. So if we want to help 10,000 families, we need $2 billion; if we want to help 25,000 families, we need $5 billion.

Carefully convert some of the historically industrial areas into new, mixed-use neighborhoods.

Stop requiring developers to build extra parking. Developers should never, ever be required by the government to build extra parking, since each space costs $40,000 to $75,000.

Require excellent design of new buildings. If people felt confident that most new construction was going to contribute as much to the city, in the long run, as the old buildings do, we would be halfway to solving the problem.

All of this, of course, happens to be the same strategy we need to embrace to fight sprawl and its attendant outcome, global warming. Not one more inch of farmland in California would need to be developed if we were just willing to put growth inside existing cities. But this requires fundamental changes in the way we have been planning our cities for a long, long time.

Slow down the Laguna project

EDITORIAL The 440-unit housing development slated for the Laguna Street site of the old UC Berkeley Extension campus is suddenly on the fast track. The Planning Department has calendared a vote on the project for Dec. 20 in what appears to be a desperate effort to get it approved before the end of the year. That may be in the interests of developer A.F. Evans, but it’s not in the interests of San Francisco, and the commissioners should be in no rush to go along.

This isn’t a typical commercial project: the land has been in the public sector for a century and has always been used for public projects. Until the 1950s it was home to San Francisco State University, and it became a UC campus in 1958. Turning public land over for private use should raise alarms anywhere, and in the middle of a dense city, where public land is scarce and affordable housing desperately needed, those alarms ought to be ringing loud and long.

In this case Evans has done a brilliant bit of political maneuvering: the market-rate housing project is paired with an 80-unit development that will be designed as retirement housing for queer seniors. That’s clearly something the city needs, and that aspect of the plan has won widespread support — and helped divert or eliminate opposition to the overall project.

But there are real issues here. For one thing, Evans plans to tear down two historic buildings (while saving three others). That was a compromise the Board of Supervisors accepted in August, but we still find it dubious. We also find dubious the notion that the developer will create public space by reopening a section of Waller Street — a public thoroughfare — that was part of the old campus.

The biggest problem, however, is the lack of affordable housing. Evans is planning to make 20 percent of the units available below market rate — but that’s a fairly small number considering that this is public land. Remember: at that ratio only 16 of the queer retirement apartments will be available to anyone who isn’t wealthy. While we agree that queer seniors of all income levels need this style of housing, which will feature community amenities and on-site services for the aging, 16 lower-cost units hardly seems like enough of a benefit to justify shifting 5.4 acres of public property into a private project. "How can the queer community settle for this, in San Francisco of all places?" queer housing activist Tommi Avicolli Mecca asks. "I think that we can do much better."

Evans is in a rush — and thus the Mayor’s Office and the City Planning Department are in a rush — because the developer’s contract with the university expires if the project isn’t approved by Jan. 1, 2008. Almost everyone involved agrees that the UC and Evans can easily reach terms on an extension, so there’s no real threat here. But it doesn’t matter — that’s not the city’s problem. San Francisco has a responsibility to ensure that big new projects serve the public interest; the developer’s deadline doesn’t trump that.

Sup. Ross Mirkarimi is asking that the affordable-housing component be increased to around 40 percent. That may take a little work: the UC, which wants to make as much money as possible off this, is charging Evans a stiff fee for the land. But with the proper pressure, including pressure on the UC from Assemblymember Mark Leno and state senator Carole Migden, a much higher ratio of low-cost housing ought to be possible.

It’s too early to approve what’s still a bad deal. The planning commissioners should turn it down, and if they don’t, the supervisors should demand more from Evans before allowing the property to go from public to private use. *

Good-bye to my city

EDITORIAL My marriage to the city is ending. Yes, the one on a peninsula tipped with astounding beauty, filled with rich cultural communities and the fullness and complexities of the growing inequities in American life.

It is the city that has witnessed the nurturing scenes of my adulthood on the West Coast of North America since 1966. I was here as the beat generation turned over my new city bride to newcomers during the Summer of Love. They called us hippies. Later I witnessed the tear gas flows at Haight and Ashbury the year that Dr. Martin Luther King Jr. was murdered in Memphis. I watched television with Students for Eugene McCarthy on Haight Street on the warm June night when Robert F. Kennedy was assassinated in Los Angeles.

Although my city bride is scarred and worn down, like any bride would be with too many lovers fighting over each blink of her aging eyes under a wrinkled brow, how can anybody leave after a 41-year love affair?

Sadly, the deepening citywide housing crisis, well documented by the Guardian, has now reached our rental home near our beloved Unitarian Church and Center.

I have been in the "good fight" for most of those 41 years in San Francisco, where I have been arrested in solidarity with homeless people, witnessed for peace and justice, and engaged the body politic at City Hall on behalf of sound environmental and planning policies. I have worked continually for better public TV and radio services, including 10 years of elected service on KQED’s Board of Directors.

Now what is a responsible lover of a city bride to do? Jump ship? Leave on the next voyage of the SS Bilge Rat?

As an aging groom, however, my choices are few.

Along with my human bride, Jean, I could live in the cramped, crowded, and often dangerous gray ghetto for folks of limited income. Perhaps we’d win the California Lottery so we could "afford" the city’s lottery for a so-called affordable-housing condo.

We could continue to mount the barricades, trying keep our bride from being dressed up for dates with the limousine-and-caviar set and the arrivistes of wealth and power who want to steal her remaining treasures.

Instead, we are now heading toward building a new community in Boulder, Colo., where my life in the West began nearly 50 years ago as a college student. We will be members one of America’s first cohousing villages designed by elders who are now building an intentional community of self-managed affordable and market-rate units in a city where there are successful policies geared to meet the housing needs of all income groups.

In many marriages facing uncertain challenges, at times ties are dissolved unwillingly. I will miss my haughty, imperial, and strangely vulnerable city bride called the city of St. Francis — in Spanish, San Francisco.

To you, the remaining citizens of San Francisco: I have had a wonderful relationship with my city bride, with many gifts from insightful people. It was a time of great love, affection, expectations met and unmet, with disappointments and frustrations and — of course — laughs and tears. I have had them all with you.

Fisher fails

The crowd at El Rio, the Mission Street dive bar, was reaching capacity election night when Sup. Aaron Peskin climbed onto an unstable bar stool to announce a political victory that had been very much in doubt just a few weeks earlier.

“They said it could not be done. We drove a Hummer over Don Fisher!” Peskin said, referring to the Republican billionaire and downtown power broker who funded the fight against progressives in this election, as he has done repeatedly over the years.

Indeed, the big story of this election was the improbable triumph of environmentalists over car culture and grassroots activism over downtown’s money. The battleground was Muni reform measure Proposition A, which won handily, and the pro-parking Proposition H, which went down to resounding defeat.

It was, in some ways, exactly the sort of broad-based coalition building and community organizing that the progressives will need to help set the city’s agenda going into a year when control of the Board of Supervisors is up for grabs.

“I just felt it at El Rio — wow, people were jazzed,” said campaign consultant Jim Stearns, who directed the Yes on A–No on H campaign. “We brought in new energy and new people who will be the foot soldiers and field managers for the progressive supervisorial candidates in 2008.”

Maintaining the momentum won’t be simple: many of the people in El Rio that night will be on opposite sides next June, when Assemblymember Mark Leno challenges incumbent state senator Carole Migden, and they’ll have to put aside their differences just a few months later.

Downtown, while soundly defeated this time around, isn’t going to give up. And some parts of the winning coalition — Sup. Sean Elsbernd, for example, who helped with west-side voters, and the San Francisco Planning and Urban Research Association (SPUR), which helped bring more moderate voters into the fold — probably aren’t going to be on the progressive side in Nov. 2008.

But there’s no doubt the Yes on A–No on H campaign was a watershed moment. “I’ve never seen this kind of coalition between labor and environmentalists in the city,” Robert Haaland, a union activist who ran the field campaign, told us. “New relationships were built.”

During his victory speech, Peskin singled out the labor movement for high praise: “This would not have happened if it were not for our incredible brothers and sisters in the house of labor.” He also thanked the San Francisco Bicycle Coalition and environmental groups — and agreed that the labor-environmental alliance was significant and unique. “This is the first time in the seven years that I’ve been on the Board of Supervisors where I have seen a true coalition between labor and the environmentalists,” he said.

It’s not clear what we can expect in 2008 from Mayor Gavin Newsom, whom the latest results show finishing with more than 70 percent of the vote, better than some of his own consultants predicted. Newsom endorsed Yes on A–No on H, but he did nothing to support those stands, instead focusing on defeating Question Time proposition E, which narrowly failed.

Will Newsom continue to pay fealty to the biggest losers of this election, the San Francisco Chamber of Commerce and Fisher, who funded No on A–Yes on H and became this year’s antienvironmentalism poster child?

Or will Newsom — who has said little of substance about his plans for 2008 — step to the front of the transit-first parade and try to drive a wedge in the labor-environmentalist-progressive coalition that achieved this election’s biggest come-from-behind victory?

 

MONEY AND PEOPLE

The Yes on A–No on H campaign was a striking combination of good ground work by volunteers committed to alternative transportation and solid fundraising that allowed for many mailers and a sophisticated voter identification, outreach, and turnout effort.

“We worked the Muni a lot in the last days, particularly in areas where we thought there were a lot of young people,” Stearns said.

Polls commissioned by the Yes on A–No on H campaign showed that Prop. H, which would have deregulated parking and attracted more cars downtown, was winning by 54–39 percent as of Aug. 30. By Oct. 25 that lead had narrowed to 40–41 percent, a trend that gave the campaign hope that a big final push would produce a solid margin of victory, particularly given that more detailed polling questions showed support dropped fast once voters were educated on the real potential impacts of the measure.

Prop. A was much closer throughout the race, particularly given that both daily newspapers and left-leaning Sups. Gerardo Sandoval and Jake McGoldrick opposed it and even the Green Party couldn’t reach consensus on an endorsement.

“This could have meant a lot of arrows from a lot of directions,” Stearns said.

Campaign leaders Peskin, Haaland, and Stearns were so worried about Prop. A being defeated — and about not having the money for a big final telephone canvas in the final days — that they decided to make last-minute appeals for money.

“I’ve been a nervous wreck about this,” Haaland said of the campaign on election night.

On the evening of Nov. 3, he placed an anxious call to Peskin, suggesting that the latter make an appeal for money to Clint Reilly, a real estate investor who has often helped fund progressive efforts.

Peskin agreed and asked Stearns to help him make the pitch — and the two men drove to Reilly’s Seacliff home at 10 p.m. on Nov. 3.

“Prop. A just struck me as a nice, decent, positive message,” Reilly told the Guardian at the election night party, which he attended with his wife, Janet Reilly, a former State Assembly candidate.

Sharing Peskin and the campaign’s concerns that Prop. A was in trouble, Reilly cut a check for $15,000, which was enough to keep the phone banks going and help give the measure a narrow margin of victory.

But the money alone wasn’t enough for this mostly volunteer-run campaign.

“The push we made on the last five days of this campaign was just incredible,” campaign manager Natasha Marsh told us. “We had close to 500 volunteers on that last four days.”

 

A DIFFERENT CITY

The campaign also developed an extensive list of potentially supportive absentee voters — fully half of them Chinese speaking — who were then contacted with targeted messages.

Rosa Vong-Chie, who coordinated the voter outreach effort, said the messages about climate change, clean air, and Fisher’s involvement worked well with English-language voters. Chinese speakers didn’t care as much about Fisher, so campaign workers talked to them about improving Muni service.

The absentee-voter drive (and the push among Chinese-language voters) was unusual for a progressive campaign — and the fact that Prop. A did so well among typically conservative absentee voters was a testament to the effort’s effectiveness.

Elsbernd, one of the most conservative members of the Board of Supervisors, crossed many of his political allies to support the Yes on A–No on H campaign, and his involvement helped win over west-side voters and demonstrated that environmentalism and support for transit shouldn’t be just progressive positions.

“It’s great for public transit riders. It reinforces that this is a transit-first city…. Public transit is not an east-side issue,” Elsbernd told us, adding that the election was also a victory for political honesty. “It shows that people saw through the campaign rhetoric.”

The Fisher-funded rhetoric relied on simplistic appeals to drivers’ desire for more parking and used deceptive antigovernment appeals, trying to capitalize on what he clearly thought was widespread disdain for the Board of Supervisors.

“The attacks against the board didn’t work,” Peskin said, noting that in election after election the supervisors have shown that they “have much longer coattails than the chief executive of San Francisco.”

“I think it’s a pretty thorough rejection of Don Fisher’s agenda. He was not able to fool the voters,” said Tom Radulovich, director of Livable City and a BART director, who was active in the campaign. “This was about transit and what’s best for downtown. We should be very proud as a city.”

 

NOW WHAT?

The day after the El Rio party, at the monthly Car Free Happy Hour — a gathering of alternative-transportation activists and planners — there was excited talk of the previous night’s electoral triumph, but it quickly turned to the question of what’s next.

After all, progressives proved they could win in a low-turnout election against a poll-tested, attractive-sounding, and well-funded campaign. And given that the number of signatures needed to qualify an initiative for the ballot is a percentage of the voters in the last mayor’s race, it suddenly seems easy to meet that standard.

Some of the ideas floated by the group include banning cars on a portion of Market Street, having voters endorse bus rapid-transit plans and other mechanisms for moving transit quicker, levying taxes on parking and other auto-related activities to better fund Muni, and exempting bike, transit, and pedestrian projects from detailed and costly environmental studies (known as level of service, or LOS, reform to transportation planners).

“There’s a lot of potential to move this forward,” Haaland said later. “We can talk about creating a real transit-justice coalition.”

There’s also a downside to the low turnout: downtown can more easily place measures on the ballot or launch recall drives against sitting supervisors, which would force progressives to spend time and money playing defense.

But overall, for an election that could have been a total train wreck for progressives, the high-profile victory and the new coalitions suggest that the movement is alive and well, despite Newsom’s reelection.

TECHSPLOITATION Airlines from Virgin Blue to Quantas have been touting new ecofriendly programs under which passengers paralyzed by enviroguilt over all of those jet-fueled carbon dioxide emissions can pay an extra carbon offset fee for tickets. The money these passengers pay — sometimes as little as $1 — is supposed to go to renewable energy or unspecified green causes and therefore make airline travel carbon neutral.

Carbon offset fees may be new, but the underlying notion goes back to the Middle Ages, when the Catholic Church sold wealthy people indulgences to offset the spiritual cost of their sins and assure a place for them in heaven. And yet at least the kids in 1380 knew that indulgences were bullshit. Geoffrey Chaucer’s classic work The Canterbury Tales, written in the late 1300s, makes fun of the thoroughly corrupt pardoner character, a bombastic weirdo who constantly tries to sell everybody official-looking papers that would pardon them for their sins. Chaucer was just one of many thinkers at the time who criticized the idea that any sin can be forgiven with a little gold.

Polluting the environment isn’t a sin in the Christian sense, and yet carbon offset fees are clearly indulgences for a modern, scientific age.

I don’t mean to say that money doesn’t help ecocauses. But the problem is far more complicated than we want to believe. Our planet is in such sorry shape partly because humans are trying to better themselves. China is industrializing in order to make its citizens richer, but last week the Chinese National Population and Family Planning Commission published a report showing that environmental pollution from coal mining has caused the incidence of birth defects to jump 40 percent in the past six years.

There’s no carbon offset price you could pay to fix that. Nor is there an easy way to prevent such disasters from happening in the future if most of the world agrees that industrialization is the road to wealth. Do we use our carbon indulgence money to fund Chinese populations’ return to preindustrial life, thus dooming that nation to a second-class economic status? Perhaps we could use our money to fund education that teaches Chinese kids about alternative energy. But what kind of energy will they use in their classrooms while waiting for scientists to invent something that combusts cleanly and renewably forever?

Preservationist Marc Ancrenaz and his colleagues get it right in a recent article for PloS Biology in which they argue that preserving biodiversity must go hand in hand with eradicating poverty. "Most traditional conservation efforts were typically designed to exclude human residents," Ancrenaz’s group writes. "This failure to consider the interests of local communities has resulted in a general lack of support for conservation and subsequent degradation of protected areas." In other words, if you don’t help the people in a region, it doesn’t matter how many carbon offsets you buy — the area will still suffer.

Ancrenaz discusses two novel preservation programs that incorporate community development in their biodiversity agendas: the Kinabatangan Orang-utan Conservation Project in Borneo and the Tree Kangaroo Preservation Program in Papua New Guinea. Both programs train and hire locals as researchers who can help preserve the habitats of orangutans and tree kangaroos, respectively. I don’t want to offer programs like these as panaceas. Improperly used, they are no better than carbon indulgences. But at least they aim to address the deep connection between human poverty and environmental suffering. Even better would be programs that help locals develop new sources of wealth without requiring them to engage in logging or factory farming to earn money.

I’m not saying you should quit buying your carbon offsets, because maybe some of that money will make it into the right hands. But you should recognize your actions for what they are: guilt-inspired payouts that assuage your conscience rather than thoughtful remedies for problems that won’t be solved with indulgences alone. *

Mayor Gavin Newsom wants to give Mirant Corp. a $2 million credit to shut down its Potrero Hill power plan and is offering to devote two full-time staffers to helping the company move forward a new development for the site, documents show.

An Oct. 30 agreement between the Mayor’s Office and the Atlanta energy company, obtained under the Sunshine Ordinance, lays out a generous city program to encourage the shutdown — even though city officials say the pollution-spewing plant will almost certainly be closed anyway.

Negotiations are moving forward on the city’s plan to construct a new fossil fuel–burning power plant with two "peakers" between the Dogpatch and Bayview neighborhoods — a project that supporters say will make the Mirant plant economically unviable and lead to its closure.

The 145-megawatt single-cycle natural gas–burning power plant, part of San Francisco’s Electric Reliability Project, is necessary to meet a need for in-city energy reliability, according to the California Independent System Operator, a state agency that controls the power grid.

But the city’s Public Utilities Commission argues that the peakers will obviate the need to keep the Mirant plant running — and Cal-ISO has agreed to pull the company’s lucrative contract for providing power and transfer it to San Francisco once the new city-owned turbines are in place.

Critics are worried that the southeast part of the city could wind up with the worst of all worlds — that Mirant would keep its plant open and the peakers would operate too, increasing the level of airborne pollution in a neighborhood that has suffered environmental injustice for decades.

Now it appears the city has secured a solid guarantee that Mirant will shutter its Potrero plant — at a price.

"Mirant is committing to shut down once the plant is no longer needed for reliability," Jesse Blout, chief of staff of the Mayor’s Office of Workforce and Economic Development, told us. "It’s not economic to run that plant once our plant’s in place."

The city is now seeking a legally binding agreement to secure that closure — and offering a sweet deal to get it.

According to a copy of the current term sheet that’s being negotiated between San Francisco and Mirant, in exchange for the company agreeing to close the plant once it’s no longer needed for reliability, the city "will agree to immediately designate a senior staff member from each of the Mayor’s Office of Economic and Workforce Development and the Planning Department" and "agree to review and process on a priority basis a completed application for a proposed site plan."

Additionally, the term sheet reads, "In light of the public benefits associated with expediting closure of the Potrero Power Plant, the city will agree that … Mirant will receive a credit of up to $2,000,000 — without interest — against certain city fees and costs, as described below, that would otherwise be payable in connection with review and approval of the site plan and any development project."

Felicia Browder, director of media relations for Mirant, confirmed that closure of the plant is imminent, once the state contract is terminated. However, she would not discuss details of the future use of the 27-acre site, as the deal is not finalized, something that’s supposed to happen this week.

Blout told us a deed restriction prohibits residential use of the land, and he predicted some kind of light industry for the area. The property, located at the bay’s edge between 22nd and 23rd streets, is also home to some of the toxic spoils of industry, which Pacific Gas and Electric Co., the original owner of the site, agreed to clean up to nonresidential standards when it sold its holdings to Mirant.

PUC members expressed satisfaction with the pending shutdown and voted unanimous approval of an Oct. 31 resolution authorizing the commission’s general manager, Susan Leal, to move forward with the plan. The resolution also includes clauses banning the sale of energy for profit from the three combustion turbines at the in-city facility and exploring whether two instead of three CTs could meet reliability needs.

The financing and control of the peaker project is also changing. Initially, the city negotiated a public-private partnership with JPower, a Japanese energy company with an Illinois subsidiary, to finance the $230 million project for two plants — the 145 MW in-city facility and another 48 MW plant located at San Francisco International Airport. Under the original deal, JPower would own and operate both plants for a period of some years before turning them over to the city. Now, however, the city is committing to financing the project and owning it outright, and the contract with JPower will be for operation and maintenance. "It makes more policy sense," Blout said, adding that after 12 to 14 years, "we will own the units free and clear." He said the city plans to issue tax-exempt bonds but at this point was uncomfortable stating how much they would be for.

Though JPower will be staffing the plant for the city, it will not be making a profit. "In the contract it will stipulate they can only run when Cal-ISO calls for them for reliability," the PUC’s Tony Winnicker said.

However, the 48 MW plant located at the airport will still be owned and operated by JPower for a 30-year period, and that plant is licensed to operate for 4,900 hours a year. "JPower will be able to operate that unit up to its limit," Winnicker said. "That’s part of what makes the deal profitable for JPower."

A mixed bag of environmentalists, social justice advocates, and Bayview and Potrero residents who are neighbors of the new and old plants still opposes the city building any new fossil fuel power plants. The Brightline Defense Project is currently representing the A. Philip Randolph Institute, Californians for Renewable Energy, and two citizens in litigation seeking to halt the building of the new plant.

Eric Brooks of Our City, a local public interest group, expressed skepticism of the plan to swap one power plant for another. "We would send the worst possible message to the world by building a fossil fuel power plant in our city limits at the very beginning of what must be a renewable-energy century," he told us. He’s also urging the city to let lapse Mirant’s water and air permits, which are set to expire in 2008 and 2010, respectively.

Other opposition to the city’s power plants has come from PG&E, through the Close It! Coalition, a group the utility company founded and financially supports. "These new plants will further our reliance on fossil fuels and contribute to global warming," the group states on its Web site. However, PG&E has a 20-year contract with a similar peaker plant under construction in Fresno and is building three new fossil fuel plants of its own in Antioch, Eureka, and Colusa. PG&E, of course, also wants to keep any hint of public power out of San Francisco.
