Public safety adrift

Shortly into his first term as mayor, Gavin Newsom told a caller on talk radio — who was threatening to start a recall campaign if the mayor didn’t solve the city’s homicide problem — that Newsom might sign his own recall petition if he didn’t succeed in reducing violent crime.

But Newsom didn’t reduce violence — indeed, it spiked during his tenure — nor did he hold himself or anyone else accountable. Guardian interviews and research show that the city doesn’t have a clear and consistent public safety strategy. Instead, politics and personal loyalty to Newsom are driving what little official debate there is about issues ranging from the high murder rate to protecting immigrants.

The dynamic has played out repeatedly in recent years, on issues that include police foot patrols, crime cameras, the Community Justice Court, policies toward cannabis clubs, gang injunctions, immigration policy, municipal identification cards, police-community relations, reform of San Francisco Police Department policies on the use of force, and the question of whether SFPD long ago needed new leadership.

Newsom’s supporters insist he is committed to criminal justice. But detractors say that Newsom’s political ambition, management style, and personal hang-ups are the key to understanding why, over and over again, he fires strong but politically threatening leaders and stands by mediocre but loyal managers. And it explains how and why a vacuum opened at the top of the city’s criminal justice system, a black hole that was promptly exploited by San Francisco-based U.S. Attorney Joseph Russoniello, who successfully pressured Newsom to weaken city policies that protected undocumented immigrants accused of crimes.

Since appointing Heather Fong as chief of the San Francisco Police Department in 2004, Newsom has heard plenty of praise for this hardworking, morally upright administrator. But her lack of leadership skills contributed to declining morale in the ranks. So when he hired the conservative and controversial Kevin Ryan as director of the Mayor’s Office of Criminal Justice — the only U.S. Attorney fired for incompetence during the Bush administration’s politicized 2006 purge of the Department of Justice, despite Ryan’s statements of political loyalty to Bush — most folks assumed it was because Newsom had gubernatorial ambitions and wanted to look tough on crime.

Now, with Fong set to retire and a new presidential administration signaling that Russoniello’s days may be numbered, some change may be in the offing. But with immigrant communities angrily urging reform, and Newsom and Ryan resisting it, there are key battles ahead before San Francisco can move toward a coherent and compassionate public safety strategy.

SHIFTING POLICIES


The combination of Ryan, Fong, and Newsom created a schizophrenic approach to public policy, particularly when it came to immigrants. Fong supported the sanctuary city policies that barred SFPD from notifying federal authorities about interactions with undocumented immigrants, but Ryan and many cops opposed them. That led to media leaks of juvenile crime records that embarrassed Newsom and allowed Russoniello and other conservatives to force key changes to this cherished ordinance.

Russoniello had opposed the city’s sanctuary legislation from the moment it was introduced by then Mayor Dianne Feinstein in the 1980s, when he serving his first term as the U.S. Attorney for Northern California. But it wasn’t until two decades later that Russoniello succeeded in forcing Newsom to adopt a new policy direction, a move that means local police and probation officials must notify federal authorities at the time of booking adults and juveniles whom they suspect of committing felonies

Newsom’s turnabout left the immigrant community wondering if political ambition had blinded the mayor to their constitutional right to due process since his decision came on the heels of his announcement that he was running for governor. Juvenile and immigrant advocates argue that all youth have the right to defend themselves, yet they say innocent kids can now be deported without due process to countries where they don’t speak the native language and no longer have family members, making them likely to undertake potentially fatal border crossings in an effort to return to San Francisco.

Abigail Trillin of Legal Services for Children, cites the case of a 14-year-old who is in deportation proceedings after being arrested for bringing a BB gun to school. "He says he was going to play with it in the park afterwards, cops and robbers," Trillin says. "His deportation proceedings were triggered not because he was found guilty of a felony, but because he was charged with one when he was booked. He spent Christmas in a federal detention facility in Washington state. Now he’s back in San Francisco, but only temporarily. This boy’s family has other kids, they are part of our community. His father is a big, strong man, but every time he comes into our office to talk, he is in tears."

Another client almost got referred to U.S. Immigration and Custom Enforcement (ICE) even though he was a victim of child abuse. And a recent referral involved a kid who has been here since he was nine months old. "If the mayor genuinely wants to reach out to the immigrant community, he needs to understand how this community has perceived what has happened," Trillin said. "Namely, having a policy that allows innocent youth to be turned over to ICE."

Social workers point out that deporting juveniles for selling crack, rather than diverting them into rehabilitation programs, does nothing to guarantee that they won’t return to sell drugs on the streets. And making the immigrant community afraid to speak to law enforcement and social workers allows gangs and bullies to act with impunity.

"This is bad policy," Trillin stated. "Forget about the rights issues. You are creating a sub class. These youths are getting deported, but they are coming back. And when they do, they don’t live with their families or ask for services. They are going far underground. They can’t show up at their family’s home, their schools or services, or in hospitals. So the gang becomes their family, and they probably owe the gang money."

Noting that someone who is deported may have children or siblings or parents who depend on them for support, Sup. John Avalos said, "There need to be standards. The city has the capability and knows how to work this out. I think the new policy direction was a choice that was made to try and minimize impacts to the mayor’s career."

But Matt Dorsey, spokesperson for the City Attorney’s Office, told the Guardian that the Sanctuary City ordinance never did assure anyone due process. "The language actually said that protection did not apply if an individual was arrested for felony crimes," Dorsey said. "People have lost sight of the fact that the policy was adopted because of a law enforcement rationale, namely so victims of crime and those who knew what was going on at the street level wouldn’t be afraid to talk to police."

Angela Chan of the Asian Law Caucus, along with the San Francisco Immigrant Rights Defense Committee, a coalition of more than 30 community groups, has sought — so far in vain — to get the city to revisit the amended policy. "The city could have reformulated its ordinance to say that we’ll notify ICE if kids are found guilty, do not qualify for immigration relief, and are repeat or violent offenders," Chan said. "That’s what we are pushing. We are not saying never refer youth. We are saying respect due process."

Asked if Newsom will attend a Feb. 25 town hall meeting that immigrant rights advocates have invited him to, so as to reopen the dialogue about this policy shift, mayoral spokesperson Nathan Ballard told the Guardian, "I can’t confirm that at this time."

Sitting in Newsom’s craw is the grand jury investigation that Russoniello convened last fall to investigate whether the Juvenile Probation Department violated federal law. "Ever since the City found out that the grand jury is looking into it, they brought in outside counsel and everything is in deep freeze," an insider said. "The attitude around here is, let the whole thing play out. The city is taking it seriously. But I hope it’s a lot of saber rattling [by Russoniello’s office]."

Dorsey told the Guardian that "the only reason the city knew that a grand jury had been convened was when they sent us a subpoena for our 1994 opinion on the Sanctuary City policy, a document that was actually posted online at our website. Talk about firing a shot over the bow!"

Others joke that one reason why the city hired well-connected attorney Cristina Arguedas to defend the city in the grand jury investigation was the city’s way of saying, ‘Fuck You, Russoniello!" "She is Carole Migden’s partner and was on O.J. Simpson’s dream team," an insider said. "She and Russoniello tangled over the Barry Bonds stuff. They hate each other."

Shannon Wilber, executive director of Legal Services for Children, says Russoniello’s theory seems to be that by providing any services to these people, public or private, you are somehow vioutf8g federal statutes related to harboring fugitives. "But if you were successful in making that argument, that would make child protection a crime," Wilber says, adding that her organization is happy to work with young people, but it has decided that it is not going to accept any more referrals from the Juvenile Probation Department.

"We no longer have the same agenda," Wilber said. "Our purpose in screening these kids is to see if they qualify for any relief, not to deport people or cut them off from services."

Wilber’s group now communicates with the Public Defender’s Office instead. "Between 80 and 100 kids, maybe more, have been funneled to ICE since this new policy was adopted," Wilber said. "This is creating an under class of teens, who are marginalized, in hiding and not accessing educational and health services for fear of being stopped and arrested for no good reason, other than that their skin is brown and they look Latino".

Wilber understands that the new policy direction came from the Mayor’s Office, in consultation with JPD, plus representatives from the US Attorney’s office and ICE. "They bargained with them," Wilber said. "They basically said, what are you guys going to be satisfied with, and the answer was that the city should contact them about anyone who has been charged and booked with a felony, and who is suspected of being undocumented."

She hopes "something shifts" with the new administration of President Barack Obama, and that there will be "enough pressure in the community to persuade the Mayor’s Office to at least amend, if not eliminate, the new policy," Wilber said "The cost of what the city is doing, compared to what it did, is the flashing light that everyone should be looking at."

"It costs so much more to incarcerate kids and deport them, compared to flying them home," she explained. "And we have cast a pall over the entire immigrant community. It will be difficult to undo that. Once people have been subjected to these tactics, it’s not easy to return to a situation of trust. We are sowing the seeds of revolution."

WEAKEST LINK


When Newsom tapped Republican attorney Kevin Ryan to head the Mayor’s Office of Criminal Justice a year ago, the idea was that this high-profile guy might bring a coherent approach to setting public safety policy, rather than lurch from issue to issue as Newsom had.

Even City Attorney Dennis Herrera, who isn’t considered close to Newsom, praised the decision in a press release: "In Kevin Ryan, Mayor Newsom has landed a stellar pick to lead the Mayor’s Office of Criminal Justice. Kevin has been a distinguished jurist, an accomplished prosecutor, and a valued partner to my office in helping us develop protocols for civil gang injunctions. San Franciscans will be extremely well served by the talent and dedication he will bring to addressing some of the most important and difficult problems facing our city."

But the choice left most folks speechless, particularly given Ryan’s history of prosecuting local journalists and supporting federal drug raids. Why on earth had the Democratic mayor of one of the most liberal cities in the nation hired the one and only Bush loyalist who had managed to get himself fired for being incompetent instead of being disloyal like the other fired U.S. Attorneys?

The answer, from those in the know, was that Newsom was seriously flirting with the idea of running for governor and hired Ryan to beef up his criminal justice chops. "If you are going to run for governor, you’ve got to get to a bunch of law and order people," one insider told us.

Ryan proceeded to upset civil libertarians with calls to actively monitor police surveillance cameras (which can only be reviewed now if a crime is reported), medical marijuana activists with recommendations to collect detailed patient information, and immigrant communities by delaying the rollout of the municipal identity card program.

"In the long run, hopefully, dissatisfaction with Ryan will grow," Assembly Member Tom Ammiano told us last year when he was a supervisor. "He could become a liability for [Newsom], and only then will Newsom fire him, because that’s how he operates."

Others felt that Ryan’s impact was overstated and that the city continued to have a leadership vacuum on public safety issues. "What has happened to MOCJ since Ryan took over?" one insider said. "He doesn’t have much of a staff anymore. No one knows what he is doing. He does not return calls. He has no connections. He’s not performing. Everyone basically describes him with the same words – paranoid, retaliatory, and explosive – as they did during the investigation of the U.S. attorneys firing scandal."

"I’ve only met him three times since he took the job," Delagnes said. "I guess he takes his direction from the mayor. He’s supposed to be liaison between Mayor’s Office and the SFPD. When he accepted the job, I was, OK, what does that mean? He has never done anything to help or hinder us."

But it was when the sanctuary city controversy hit last fall that Ryan began to take a more active role. Sheriff’s Department spokesperson Eileen Hirst recalls that "MOCJ was essentially leaderless for five years, and Ryan was brought in to create order and revitalize the office. And the first thing that really happened was the controversy over handling undocumented immigrant detainees."

One prime example of Ryan’s incompetence was how it enabled Russoniello to wage his successful assault on the city’s cherished sanctuary ordinance last year. Internal communications obtained by the Guardian through the Sunshine Ordinance show efforts by the Newsom administration to contain the political damage from reports of undocumented immigrants who escaped from city custody.

Newsom solidly supported the Sanctuary City Ordinance during his first term, as evidenced by an April 2007 e-mail that aide Wade Crowfoot sent to probation leaders asking for written Sanctuary City protocols. But these demands may have drawn unwelcome attention.

"This is what caused the firestorm regarding undocumented persons," JPD Assistant Chief Allen Nance wrote in August 2008 as he forwarded an e-mail thread that begins with Crowfoot’s request.

"Agreed," replied probation chief William Siffermann. "The deniability on the part of one is not plausible."

Shortly after Ryan started his MOCJ gig, the Juvenile Probation Department reached out to him about a conflict with ICE. They asked if they could set up something with the U.S. Attorney’s Office but the meeting got canceled and Ryan never rescheduled it.

Six weeks passed before the city was hit with the bombshell that another San Francisco probation officer had been intercepted at Houston Airport by ICE special agents as he escorted two minors to connecting flights to Honduras. They threatened him with arrest.

"Special Agent Mark Fluitt indicated that federal law requires that we report all undocumenteds, and San Francisco Juvenile Court is vioutf8g federal law," JPD’s Carlos Gonzalez reported. "Although I was not arrested, the threat was looming throughout the interrogation."

Asked to name the biggest factors that influenced Newsom’s decision to shift policy, mayoral spokesperson Nathan Ballard cites a May 19 meeting in which Siffermann briefed the mayor about JPD’s handling of undocumented felons on matters related to transportation to other countries and notification of ICE.

"That morning Mayor Newsom directed Siffermann to stop the flights immediately," Ballard told the Guardian. "That same morning the mayor directed Judge Kevin Ryan to gather the facts about whether JPD’s notification practices were appropriate and legal. By noon, Judge Ryan had requested a meeting with ICE, the U.S. Attorney, and Chief Siffermann to discuss the issue. On May 21, that meeting occurred at 10:30 a.m. in Room 305 of City Hall."

Ballard claims Ryan advised the mayor that some of JPD’s court-sanctioned practices might be inconsistent with federal law and initiated the process of reviewing and changing the city’s policies in collaboration with JPD, ICE, the U.S. Attorney, and the City Attorney.

Asked how much Ryan has influenced the city’s public safety policy, Ballard replied, "He is the mayor’s key public safety adviser."

Records show Ryan advising Ballard and Ginsburg to "gird your loins in the face of an August 2008 San Francisco Chronicle article that further attacked the city’s policy. "Russoniello is quoted as saying, "This is the closest thing I have ever seen to harboring,’" Ryan warned. And that set the scene for Newsom to change his position on Sanctuary City.

PUSHED OR JUMPED?


When Fong, the city’s first female chief and one of the first Asian American women to lead a major metropolitan police force nationwide, announced her retirement in December, Police Commission President Theresa Sparks noted that she had brought "a sense of integrity to the department." Fellow commissioner David Onek described her as "a model public servant" and residents praised her outreach to the local Asian community.

Fong was appointed in 2004 in the aftermath of Fajitagate, a legal and political scandal that began in 2002 with a street fight involving three off-duty SFPD cops and two local residents, and ended several years later with one chief taking a leave of absense, another resigning, and Fong struggling to lead the department. "It’s bad news to have poor managerial skills leading any department. But when everyone in that department is waiting for you to fail, then you are in real trouble," an SFPD source said.

Gary Delagnes, executive director of the San Francisco Police Officers Association, hasn’t been afraid to criticize Fong publicly, or Newsom for standing by her as morale suffered. "Chief Fong has her own style, a very introverted, quiet, docile method of leadership. And it simply hasn’t worked for the members of the department. A high percentage [of officers] believe change should have been made a long time ago."

But Newsom refused to consider replacing Fong, even as the stand began to sour his relationship with the SFPOA, which has enthusiastically supported Newsom and the mayor’s candidates for other city offices.

"The day the music died," as Delagnes explains it, was in the wake of the SFPD’s December 2005 Videogate scandal. Fong drew heavy fire when she supported the mayor in his conflict with officer Andrew Cohen and 21 other officers who made a videotape for a police Christmas party. Newsom angrily deemed the tape racist, sexist, and homophobic at a press conference where Fong called the incident SFPD’s "darkest day."

"Heather let the mayor make her look like a fool. Who is running this department? And aren’t the department’s darkest days when cops die?" Delagnes said, sitting in SFPOA’s Sixth Street office, where photographs and plaques commemorate officers who have died in service.

Delagnes supports the proposal to give the new chief a five-year contract, which was part of a package of police reforms recommended by a recent report that Newsom commissioned but hasn’t acted on. "You don’t want to feel you are working at the whim of every politician and police commission," Delagnes said. But he doubts a charter amendment is doable this time around, given that the Newsom doesn’t support the idea and Fong has said she wants to retire at the end of April.

"I’d like to see a transition to a new chief on May 1," Delagnes said. "And so far, there’s been no shortage of applications. Whoever that person is, whether from inside or outside [of SFPD], must be able to lead us out of the abysmally low state of morale the department is in."

Delagnes claims that police chiefs have little to do with homicide rates, and that San Francisco is way below the average compared to other cities. "But when that rate goes from 80 to 100, everyone goes crazy and blames it on the cops. None of us want to see people killed, but homicides are a reality of any big city. So what can you do to reduce them? Stop them from happening."

But critics of SFPD note that few homicide cases result in arrests, and there is a perception that officers are lazy. That view was bolstered by the case of Hugues de la Plaza, a French national who was living in San Francisco when he was stabbed to death in 2007. SFPD investigators suggested it was a suicide because the door was locked from the inside and did little to thoroughly investigate, although an investigation by the French government recently concluded that it was clearly a homicide.

Delagnes defended his colleagues, saying two of SFPD’s most experienced homicide detectives handled the case and that "our guys are standing behind it."

A NEW DIRECTION?


Sparks said she didn’t know Fong was planning to retire in April until 45 minutes before Chief Fong made the announcement on Newsom’s December 20 Saturday morning radio show. "I think she decided it was time," Sparks told the Guardian. "But she’s not leaving tomorrow. She’s waiting so there can be an orderly transition."

By announcing she will be leaving in four months, Fong made it less likely that voters would have a chance to weigh in on the D.C.-based Police Executives Reform Forum’s recommendation that the next SFPD chief be given a five-year contract.

"The mayor believes that the chief executive of a city needs to have the power to hire and fire his department heads in order to ensure accountability," Newsom’s communications director Nathan Ballard told the Guardian.

According to the city charter, the Police Commission reviews all applications for police chief before sending three recommendations to the mayor. Newsom then either makes the final pick, or the process repeats. This is same process used to select Fong in 2004, with one crucial difference: the commission then was made up of five mayoral appointees. Today it consists of seven members, four appointed by the mayor, three by the Board of Supervisors.

Last month the commission hired Roseville-based headhunter Bob Murray and Associates to conduct the search in a joint venture with the Washington-based Police Executive Research Forum, which recently completed an organizational assessment of the SFPD. Intended to guide the SFPD over the next decade, the study recommends expanding community policies, enhancing information services, and employing Tasers to minimize the number of deadly shootings by officers.

"The mayor tends to favor the idea [of Tasers] but is concerned about what he is hearing about the BART case and wants closer scrutiny of the issue," Ballard told us last week.

Potential candidates with San Francisco experience include former SFPD deputy chief Greg Suhr, Taraval Station Captain Paul Chignell, and San Mateo’s first female police chief, Susan Manheimer, who began her career with the SFPD, where her last assignment was as captain of the Tenderloin Task Force.

"It would be wildly premature to comment on the mayor’s preference for police chief at this time," Ballard told the Guardian.

Among the rank and file, SFPD insider Greg Suhr is said to be the leading contender. "He’s very politically connected, and he is Sup. Bevan Dufty’s favorite," said a knowledgeable source. "The mayor would be afraid to not get someone from the SFPD rank and file."

Even if Newsom is able to find compromise with the immigrant communities and soften his tough new stance on the Sanctuary City policy, sources say he and the new chief would need to be able to stand up to SFPD hardliners who push back with arguments that deporting those arrested for felonies is how we need to get rid of criminals, reduce homicides, and stem the narcotics trade.

"The police will say, you have very dangerous and violent potential felons preying on other immigrants in the Mission and beyond," one source told us. "They would say [that] these are the people who are dying. So if you are going to try and take away our tools — including referring youth to ICE on booking — then we will fight and keep on doing it."

While that attitude is understandable from the strictly law and order perspective, is this the public safety policy San Francisco residents really want? And is it a decision based on sound policy and principles, or merely political expediency?

Sup. David Campos, who arrived in this country at age 14 as an undocumented immigrant from Guatemala, says he is trying to get his arms around the city’s public safety strategy. "For me, the most immediate issue is the traffic stops in some of the neighborhoods, especially in the Mission and the Tenderloin," said Campos, a member of the Public Safety Committee whose next priority is revisiting the Sanctuary City Ordinance. "I’m hopeful the Mayor’s Office will reconsider its position. But if not, I’m looking at what avenues the board can pursue.

"I understand there was a horrible and tragic incident," Campos added, referring to the June 22, 2008 slaying of three members of the Bologna family, for which Edwin Ramos, who had cycled in and out of the city’s juvenile justice system and is an alleged member of the notoriously violent MS-13 gang, charged with murder for shooting with an AK-47 assault weapon. "But I think it is bad to make public policy based on one incident like that. To me, the focus should be, how do we get violent crime down and how do we deal with homicides?"

Campos believes Ryan has sidetracked the administration with conservative hot-button issues like giving municipal ID cards to undocumented residents, installing more crime cameras, and cracking down on the cannabis clubs. "I’m trying to understand the role of the Mayor’s Office of Criminal Justice," Campos said, raising the possibility that it might be eliminated as part of current efforts to close a large budget deficit. "In tough times, can we afford to have them?"

The change in Washington could also counter San Francisco’s move to the right. Federal authorities, swamped by claims of economic fraud and Ponzi schemes, might lose interest in punishing San Francisco for its Sanctuary City-related activities now that President Barack Obama has vowed to address immigration reform, saying he wants to help "12 million people step out of the shadows."

"It’s hard to believe that there isn’t going to be some kind of change," another criminal justice community source told us. "A lot of this is Joe Russoniello’s thing. Sanctuary City ordinances and policies have been a target of his for years."

Rumors swirled last week that Russoniello might have already received his marching orders when Sen. Barbara Boxer announced her judicial nomination committees, which make recommendations to Obama for U.S. District Court judges, attorneys, and marshals.
Boxer will likely be responsible for any vacancies in the northern and southern districts, while Feinstein, who is socially friendly with the Russoniello family, will take charge of the central and eastern districts. Criminal justice noted that Arguedas, who San Francisco hired to defend itself against Russoniello’s grand jury investigation, is on Boxer’s Northern District nomination committee.
Boxer spokesperson Natalie Ravitz told the Guardian she was not going to comment on the protocol or process for handling a possible vacancy. "What I can tell you is that Sen. Boxer is accepting applications for the position of U.S. Attorney for the Southern District (San Diego), a position that is considered vacant," Ravitz told us. "Sen. Feinstein is handling the vacancy for the U.S. Attorney for the Eastern District. Beyond that I am not going to comment. If you have further questions, I suggest you call the Department of Justice press office."
DOJ referred us to the White House, where a spokesperson did not reply before press time. Meanwhile Russoniello has been publicly making the case for why he should stay, telling The Recorder legal newspaper in SF that morale in the U.S. Attorney’s San Francisco office is much improved, with fewer lawyers choosing to leave since he took over from Ryan.
That’s small consolation, given widespread press reports that Ryan had destroyed morale in the office with leadership that was incompetent, paranoid, and fueled by conservative ideological crusades. Now the question is whether a city whose criminal justice approach has been dictated by Ryan, Fong, and Newsom — none of whom would speak directly to the Guardian for this story — can also be reformed.

Ever since the San Francisco Planning Commission denied American Apparel’s request to set up shop in the Mission by a 7-0 vote because of you wonderfully protest-happy people of San Francisco, I’ve been wondering if the battle is really over. American Apparel is already trying to kill us with kindness, by offering anyone with a valid Mission address on their California driver’s license 25% off anything in the store until March 15, possibly because they know that they’d lose approximately 75% of their business in San Francisco if Mission hipsters suddenly decided they didn’t have a fondness for unisex slacks anymore. It’s a nice offer, surely, but personally, I’d feel hypocritical for using it.

As we’ve seen in this struggle, American Apparel is an aggressive corporation with a lot of muscle. It’s nice that they’re appeasing Mission residents with this 25% off offer — though in these tough times, even with the discount, I don’t know many people who want to spend $25 on a disco unitard. [Ed Note: And the offer will drive business out of the Mission! Clever, clever.] But what if the assault doesn’t end here? What if the olive branch is just a way for American Apparel to pull the wool over our eyes, while they hatch their plot to punish San Francisco for denying them access to Valencia Street? Remember that the term “kill with kindness” originated in Shakespeare’s Taming of the Shrew, from Petruchio’s line: “This is a way to kill a wife with kindness,” and ultimately refers to the following tactic: divert attention, then attack.

I’m not saying we should boycott American Apparel. I’m saying that if we have to go into battle once again, we need to be just as prepared as we were for the last one. After much study and consideration, I present to you a countdown of eight possible revenge attacks by American Apparel, after the jump.

American Apparel makes amends with the Mission

When Mission residents mounted an opposition campaign to an American Apparel opening a store on Valencia Street, the chain didn’t respond very well and ended up being denied by the Planning Commission last week. But it has now chosen to respond to that defeat in a way that’s smart, classy, and respectful of the Mission hipsters that are its core demographic.

As reported on the blog Mission Mission, American Apparel has posted a conciliatory note on the vacant storefront it’s leasing, saying it has learned an important lesson about how to properly approach neighborhoods like the Mission and offering all Mission residents a 25 percent discount at its other San Francisco stores.

In the righteous battle against corporate homogenization, the case against American Apparel was always what attorneys call “a wobbler.” Opponents raised valid concerns, but this company was never the devil. And now that it followed up in stand-up fashion, we can all still wear our AA undies with pride.

It seems everyone has a pillow fight fantasy. For some, it’s along the lines of the slumber party/adolescent masturbation material variety. For the brilliant cacophonists who started the annual Valentine’s Day pillow fight in Justin Herman Plaza, it’s more flash mob than skin flick. But don’t think that takes any of the sexiness out of it.

Oh, no.

In fact, there are few things more exciting, more cathartic, and just plain fun than hundreds of strangers hitting each other with soft things in the name of love. So grab your pals and your pillows and head to the Embarcadero on Saturday. Just remember: hide your bedding the best you can on the way there, and don’t start swingin’ til the clock hits six.

Tomorrow’s Supes meeting: next round on special election

As expected, Mayor Gavin Newsom has vetoed an ordinance approved on Jan. 27 by the San Francisco Board of Supervisors modifying regular election procedures in order to pave the way for a special election to be held on June 2. The election would give voters an opportunity to decide on a number of tax measures that could raise city revenues in the face of a looming $576 million city budget deficit for the 2009-10 fiscal year.

“I understand the argument that revenue measures passed in June will bring in funding sooner than measures passed in November,” the mayor wrote in a letter explaining his decision. “However, if new tax and revenue measures put on the ballot in June do not pass due to a lack of unified support and planning, not only will the City incur the significant expense of a $3.5 million election, it will also critically damage our chances for success in November.”

Yesterday, after a long afternoon of statements from a few supporters and many opponents of American Apparel opening a new store at 988 Valencia Street, the San Francisco Planning Commission voted 7-0 to deny the Los Angeles-based chain the permit they needed to open.

The Commission Chambers at City Hall were packed to capacity as the Planning Commission began its regular meeting. The extra attendees, many of them organized by the hastily-formed “Stop American Apparel” campaign, were moved to two rooms with video monitors which broadcast the meeting.

It was strong show of force by grassroots organizers, one that forced a vote that few thought would be so decisive.

In the fractious atmosphere that dominates meetings concerned with Lennar’s plan to redevelop the economically depressed southeast sector of San Francisco, reality is relative to one’s perspective on this ambitious project.

At these meetings, competing factions within the Bayview’s predominantly African American community typically accuse each other — as well as the mostly white engineers, planners, and scientists that Lennar and the city hired to flesh out the details of their vaguely worded but voter-approved conceptual framework — of being sellouts and traitors.

The Jan. 28 meeting, where two local advisory committees endorsed Lennar’s draft urban design plan for a 770-acre Candlestick Point/Hunters Point Shipyard development, was typical. It was held at the Southeast Community Facility, within sniffing distance of a seismically suspect sewage treatment plant.

The committee’s endorsement came at the end of a meeting that was full of what critics labeled "disingenuous claims" by representatives from Lennar, the Mayor’s Office, the San Francisco Redevelopment Agency, and the city’s Planning Department; recriminatory accusations by community members; and disruptive chants of "A-B-Uuuu!" by a female member of Aboriginal Blackmen United, who claimed that ABU members have been starved for work at Lennar’s development. Records show Lennar paid ABU trainees $11,300 in fiscal year 2005–06 for work at the Shipyard’s Parcel A.

Fanning the flames was a report that local environmental nonprofit Arc Ecology released last month. Arc’s report faults Lennar’s urban design plan for not including comparisons with realistic alternatives and for failing to study the cumulative impact of the 15 developments, covering 1,500-2,000 acres, currently underway on the eastern waterfront.

"The practice of ‘island’ development prevents the city from conceiving a cohesive vision for the east waterfront," Arc Ecology’s January 15 report states. "Moreover, the piecemeal approach cannot adequately address the practical consequences of the addition of 50,000 new residences to the area."

Noting that Lennar’s proposal calls for a 60 percent increase in the neighborhood’s population as more than 20,000 new residents join the 33,000 people who already live in the neighborhood, Arc’s report lists alternatives that "would strengthen the economic, social and environmental benefits, while avoiding and reducing some significant impacts."

Financed by a California Wellness Foundation grant, Arc’s report stressed that it does not disagree with the stated objectives of Lennar’s development plan as laid out in Proposition G, which voters approved in June. In fact, the organization did little to voice its concerns before the election.

But the report has ruffled the feathers of city leaders, who seem hell-bent on moving the project forward and applying for funding from the federal economic stimulus package. The report calls for a focus on doing "bottom-up" ecological planning, creating real economic opportunities for the Bayview community, relocating the proposed football stadium, and removing the shipyard’s highly contaminated Parcel E2 from the project.

Noting that Lennar’s environmental impact report has yet to be completed, and that there has been no time to study Arc’s report, Citizens Advisory Committee member Scott Madison argued that delaying the endorsement would have no impact on Lennar’s home building or job creation schedule. "It’s not going to slow down anyone getting a job by even one day if we take a few days," Madison said. "But once we approve this — even a draft, even if folks are amenable to some changes — it has a certain kind of semi-concrete to it that’s difficult to chip away."

CAC member Diana Oertel voiced her objections to Lennar’s plan to divide the 170-acre Candlestick Point State Recreation Area, the Bayview’s only large open space that provides a place for recreation and an escape from urban living. "It’s not acceptable to me to see that area cut in half, gentrified, prettified, with housing going to edge of the park," Oertel said.

Project Area Committee member Leon Muhammad said there was no way the urban design plan should be endorsed "until we have addressed all the issues, until they come up with a complete plan that makes sense, not a half-baked plan."

But then PAC member Cedric Jackson asked to hear from folks in the audience who were hungry for jobs — at which point ABU folks yelled and raised hands. "I saw 80 percent of the community stand up and say, move this process forward," Jackson then asserted. "In 2000, we were 70 percent of the community, now we’re less than 50 percent. There is an out-migration and it’s not because we don’t like San Francisco, but we’re being forced out economically. So the longer you delay, the less of us will be there, especially with the economic conditions we’re facing."

Seconded by PAC member Gary Banks, Jackson moved to endorse Lennar’s draft design plan as-is, with only PAC members Muhammad and Kristine Enea, and CAC members Oertel, Madison, and Carmen Kelley dissenting.

Reached after the meeting, ARC Ecology’s Saul Bloom acknowledged that many of the problems people face in the Bayview are related to "tension over jobs." Yet he was surprised by the strong-arm tactics by proponents of a project that won’t generate jobs for at least another year.

"There’s this blind panic, this belief that if you hold up anything, you are going to stop the whole plan," Bloom told the Guardian. He hopes that now that the vote has passed, the city and Lennar will make good on verbal promises, made before and during the Jan. 28 meeting, to review Arc Ecology’s report.

"As Scott Madison pointed out, if we’d listened to these same we-have-to-vote-yes-now voices the last time around, when we were asked to endorse Phase A, we’d never have gotten the community-benefits program," Bloom said, adding that many of the current committee members are new and inexperienced. "So it’s hard for them to see through the rhetoric and pain."

"None of us want to derail the plan," continued Bloom, whose group also receives funding from the SFRA, which is overseeing the project. "What incentive do we have? Do we want to piss off the developers, contractors, and commissioners when our contract is up?"

"The city is under the impression that there is a broad base of support for this project, by virtue of Prop. G," Bloom said. "But they are unaware of the depth of dissatisfaction citywide with this project. People are saying, ‘this is insane.’<0x2009>"

Bloom believes ARC’s report raised the ire of city leaders because they feared it would fall into the wrong hands and be used in a political campaign. "But I believe the city has let the community down by not facilitating a dialogue," Bloom observed.

In addition to questions about location of the stadium, the design of the park, the bridge over Yosemite Slough, and plans to cap a radiologically impacted landfill on Parcel E2, Bloom says the hidden story in all of this is the "unstudied cumulative impacts of the all the city’s development projects on the eastern waterfront."

Together, these projects will create 30,000 new units and attract 50,000 new residents, with Lennar’s CP/HPS development creating 10,500 units, 75 percent of which are slated to sell at market-rate prices, with condos beginning at the $500,000 mark.

"Lennar can’t possibly think they can build this number of houses and sell them at these prices, at least not for the next four years," Bloom said. "The city should have had a public dialogue about the stadium options instead of pulling a plan directly off the shelf that a reliable stadium development firm did. They say they’ve studied all these other options, but where are the studies?"

Bloom notes that Prop. G was not a mandate to build a bridge over Yosemite Slough, and that the city is currently miscounting the parks and open space acreage.

"You wonder why people have no faith," Bloom said. "To whom did the city make the overwhelming case about the park, or about putting a bridge over the slough? It seems their attitude was, ‘Bayview is a crummy neighborhood, so let’s bulldoze and rebuild it,’ whereas we look at the park and say it’s a promise unfulfilled."

He believes that Arc’s recommendation to remove Parcel E2 is a no-brainer: "You are protecting public health and the environment, creating jobs that help people pay their mortgages, and you are making the property more marketable, so value increases."

With the city having publicly committed to reviewing Arc’s material, Bloom is hopeful that the city will put the results of that study into the EIR. "We are not promoting any particular outcome," Bloom said, observing that if Lennar builds 10,000 units, BVHP will no longer be a predominantly African American neighborhood. "We are trying to be the entity that raises the difficult questions that people in city have felt, but [have] been afraid to voice, because they fear those questions will be used to stop the project in its entirety."

Reached by phone, Michael Cohen of the Mayor’s Office of Economic and Workforce Development noted that Lennar’s draft urban-design plan was completed five months ago, has been vetted extensively, and now includes 32 specific modifications based on those hearings.

"These are issues that will be addressed further," Cohen said of Arc’s report. "Some are infeasible, based on extensive technical studies. But we believe that if there is a stadium, it’s in absolutely the right position and that ARC doesn’t have an alternative plan. They haven’t done the necessary studies and they haven’t presented alternative plans that actually work."

As for Arc’s contention that Parcel E2 could be dug up and hauled out, Cohen notes that the city is in a legally binding agreement with the United States Navy, which is obligated to clean up the shipyard to a standard consistent with the city’s intended use. "We don’t control what the remedy is…. [If state and federal environment regulators] say the Navy has got to dig and haul so we can safely use it as a waterfront park, then that’s what they’ll do."

Cohen insisted that the Alice Griffith public housing project will be rebuilt, whether the 49ers stay or not, and that Lennar’s project will invest $10 million to turn "a grossly underused state park into a site comparable to Crissy Field."

American Apparel battle heads for Planning Commission

Early Saturday morning, Jan. 31, about 40 protesters stood on the sidewalk near the corner of Valencia and 21st streets — the site of a proposed American Apparel store — holding up signs that read, "Your Mission — Not Theirs." An endless stream of honks — even one from a cop car — echoed support for the anti–American Apparel cause. The next day, protesters met at Ritual Roasters for a letter-writing party and on Feb. 2, they rallied and wrote letters at an anti–A.A. event hosted at Amnesia. The movement to block the chain store is gaining momentum in advance of a Feb. 5 Planning Commission hearing.

The overwhelming majority of independent businesses in the neighborhood — including Ritual Roasters, Modern Times Bookstore, Borderlands Books, and Aquarius Records — have taken a stand against the chain, which boasts 200 outlets in 19 countries worldwide. There are three AA stores in San Francisco, including one on nearby Haight Street.

A.A. spokesperson Ryan Holiday says the sentiment is misplaced. "People think we’re a big-box retailer, but that’s not true," he told the Guardian.

The company has been pushing a different image: "We don’t like the mall-ification of America any more than you," reads a sign on the empty storefront. "But that has never been what American Apparel is about."

Many store opponents claim the campaign is not a crusade against American Apparel, a Los Angeles company that has a progressive record on labor and immigration issues. It’s about formula retail, which is already banned in several San Francisco commercial districts.

"I’m wearing American apparel underwear right now," said Kent Howie, a longtime staffer for Artists’ Television Access, which is housed in the storefront next to the proposed clothing outlet. "Our street just doesn’t want chain stores. It’s about survival."

Supervisor Bevan Dufty, who represents the district where A.A. would be located, has not taken a public position. But several months back, he met with American Apparel representatives and suggested a number of ways to do outreach in the neighborhood.

"I have seen no such evidence," Dufty told us. "Major retailers often don’t make an active contribution to the neighborhood."

Holiday insists that it’s the community’s decision, although A.A. has signed a multiyear lease for the space. "We don’t need to dictate the conversation and we don’t need to trick the people into thinking they want an American Apparel."

Bad budget ideas

EDITORIAL There’s nothing easy about solving a half-billion-dollar budget shortfall, and most of the people involved in the grisly process of making the numbers add up at San Francisco City Hall know there will be blood on the floor. Labor unions representing city workers know there will be layoffs, salary concessions, or both. Community-based organizations handling critical front-line services know they’ll have to reduce staff and curtail their mission-driven operations. The supervisors know that a lot of good projects and great ideas won’t get funded this year.

The mayor, unfortunately, isn’t acting as if this were a crisis at all — he’s been out of town more than he’s been around the past few weeks. The San Francisco Chamber of Commerce and, sadly, some small business leaders, are refusing to accept the idea that taxes — some taxes, not enough to stave off deep cuts, but enough to prevent disaster — ought to be part of any budget package.

And along with the cuts — which, as Rebecca Bowe reports on page 11, will have far-reaching implications for San Franciscans — a number of really bad ideas have been floated, most of them quick fixes that would generate cash for now, but lead to serious problems later.

Among the worst ideas the mayor has put forward — in fact, it’s one of the worst budget ideas we’ve ever heard — is the notion of increasing the number of condominium conversion permits from 200 per year to 1,500 per year, and possibly allowing every property owner waiting for a conversion permit to get one, now, for a price.

It’s true that selling off condo conversion permits would bring in revenue. Raffling off building permits and planning code variances would bring in money, and so would selling development rights in city parks, and so would auctioning off appointments to boards and commissions. There are lots of stupid ways to generate cash, and the fact that a proposal would be lucrative is not by itself an argument in favor of it — even in times like these.

There’s a good reason the city limits condo conversions. Nearly every piece of property that becomes a condominium was once a rental unit, and the speculative pressure to take rent-controlled apartments and turn them into market-rate condos is immense. It’s bad enough that tenants — particularly those with relatively low rent — face eviction every day because of the state’s Ellis Act and the push by real-estate interests to create tenancies in common. Without conversion limits, the number of those evictions would soar; rent control would be eviscerated, the cost of housing would rise, and the economic cleansing of San Francisco would roll forward another few giant steps.

Newsom and his real-estate industry allies like to say that this sort of proposal is painless, since nobody has to pay higher taxes. Only people who want to convert their units, and are willing to pay a high fee for the right, would wind up paying. But that’s silly — the tenants of San Francisco would pay the cost — an immense cost — while the wealthier property owners made profits.

Selling off the taxi medallions (see "Don’t privatize the cab medallions, 1/21/09), another Newsom idea, fits in the same category. In the short term, it could bring millions into the city coffers. Long term, it would turn control of the taxi industry back to speculators and big companies, hurting the drivers and the public.

The mayor (and Sup. Sean Elsbernd) also like to talk about eliminating set-asides — those parts of the budget that voters have earmarked for particular purposes. But most of that money (the Children’s Fund, for example) goes to worthy programs: eliminating the "set-aside" protecting doesn’t save any money unless you cut those programs.

There are plenty of good budget ideas out there (see "Beyond the bloody cuts, 12/17/08). But the supervisors ought to make it clear that the bad ones are off the table.

PS: Where were all these anti-tax folks in the Chamber and the small business community, and supervisors like Elsbernd, when the city had a chance to bring in millions without any new taxes — by creating a public power system or raising utility franchise fees? They were siding with Pacific Gas and Electric Co. That’s part of the reason we’re in this fix.

Festival for Freedom

PREVIEW It doesn’t take six degrees of separation to link the new breed of local bands performing at the University of San Francisco’s Festival for Freedom benefit show. They’re an interwoven clan of West Coast outfits with garage rock tendencies and psychedelic leanings. And they’re just about all in each other’s MySpace top eight. If I had to label, I’d consider the term "flower punks" for ’em. I mean, c’mon, San Francisco has a huge Haight-Ashbury legacy to live up to. So, in the spirit of hippiedom and smiling on your brother, the undergrads from the university’s Erasmus Community has decided to take on the cause of fighting modern-day slavery and is planning an immersion trip to Uganda and Rwanda, where they will focus their efforts on rehabilitating child soldiers.

This benefit show for that trip is a culmination of the group’s efforts in social justice awareness and activism, combined with a dose of peacenik-punk rock. Taking the stage on campus: Ty Segall, Man/Miracle, and a very Birthday Party-era Nick Cave sounding Depth Charge Revolt, among others. The bands will bring the noise, so you should bring your bucks to help support this worthwhile cause for the marginalized children of Uganda.

Newsom’s self-serving bike proposal

I was already cranking up my criticism of Mayor Gavin Newsom in this post when he announced his anemic bike-sharing proposal – 50 bikes for San Francisco versus the 20,000 in Paris, from where he made the announcement – so I wondered if perhaps I was being a little hard on the proposal. You know, poisoned by my own venom.
It seemed pretty ridiculous to spend $1 million to start a program that nobody could rely on considering there would be less than 10 bikes at each of the five locations that they’re proposing. So I listened to the chatter on the CarFree list (people who promote biking and would support a legitimate bike-sharing program), checked sites such as SF Streetsblog, and did some interviews.
And so now I can say, with great confidence, that this is indeed a really dumb and self-serving idea that has everything to do with Newsom being able to claim he started something sexy like bike sharing and nothing to do with actually promoting bicycling in San Francisco.
Hell, Blazing Saddles (the rental company that lends Newsom a ride for Bike to Work Day, the one day a year that he pedals) rents 200-700 bicycles per day in San Francisco depending on the season and weather, according to someone I spoke with there. So how exactly is the Clear Channel-administered 50 bikes going to make any difference?
MTA spokesperson Judson True did defend the proposal when I called him, telling me the 50 bikes was, “based on Clear Channel’s experience in other cities getting people used to the idea.” Clear Channel runs the only other one in the U.S., Washington DC’s shitty little 150-bike program, unlike the thousands of bikes in real programs in cities around the world. True also said the high cost is based partly on renting private property because the bike injunction, which will be lifted later this year, prohibits bike improvements on public property.
Which, to me, sounds like even more proof that Newsom decided to roll this out now because it fits into his larger political plans, beating other U.S. cities like New York that are doing actual planning to roll out real bike sharing programs. And so it goes with Mayor Press Release.

The District Six dance begins

Chris Daly will be the district six supervisor for the next two years (minus a couple of weeks), but already the dance to replace him is underway — with some surprising names floating around.

It’s no secret that Debra Walker is running, and with her long record on land-use and planning issues and her LGBT community leadership, she starts out as the leading progressive in the race. SOMA activist Jim Meko has joined the fray, too.

And the rumor mill is abuzzin with talk that School Board member Jane Kim, who by all accounts has a bright political future, is considering the race. Kim recently moved to D6, and we’ve heard from a number of people who’ve been contacted by Kim supporters about a possible supervisorial bid. Kim herself is a bit more coy: “I’m not announcing a campaign,” she told me. But she didn’t entirely rule it out: “Right now, I’m not a candidate. I haven’t decided what I’m going to do in 2010; everything’s on the table.”

And then there’s Michael Yarne, who last year left Martin Builders to take a job with the Mayor’s Office of Economic Development. Mayor Newsom doesn’t have a clear horse in that race yet (Rob Black, who works for the Chamber of Commerce, may run again, but he lost last time and is clearly a Chamber toadie, so his hopes in the liberal district aren’t that good). Yarne told us that he’s been contacted by people who think he’d be a good candidate, and he hasn’t entirely ruled it out, but “there’s no way I could run right now because I don’t live in the district.” Yarne rents in D9.

For my money, Kim is one of the brighest young stars in local politics, and she ought to stay on the school board, where she’s doing a great job, for another term, then start looking at other offices.

Obama lifts abortion gag rule before SF clash

Just in time for tomorrow’s dueling San Francisco abortion demonstrations, President Barack Obama today signed an executive order lifting the ban on U.S. funding going to family planning groups that perform abortions or provide counseling on the procedure, once again lifting the country out of the Christian fundamentalist dark ages.

The ban was first imposed by President Ronald Reagan in 1984, then rescinded by President Bill Clinton, then reinstated by President George W. Bush. Although not unexpected, the timing of Obama’s action is sure to buoy the spirits of demonstrators with the Bay Area Coalition for Our Reproductive Rights, which for the last five years has countered the massive Walk for Life, in which anti-abortion organizers bus in thousands of conservative church-goers (and their disgusting pictures of mangled fetuses) from throughout the Western U.S.

It’s been a depressing decade for progressives. In fact, it seems our inability to fight the Bush administration and its misadventures in Iraq and elsewhere left us with the symptoms of a kind of collective Chronic Fatigue Syndrome: disillusioned, disappointed, and tired. That is, until Barack Obama’s election woke us up with a little thing called Hope™.

Now that we have all this energy, though, where should we direct it? How, on an individual level, can we support the Obama administration in making real change? Michelle Obama started to answer this question when she announced the Call to Service, asking Americans to devote time to neighborhood organizations and causes on Jan. 19 and beyond, via www.usaservice.org.

We’d like to add to the discussion by highlighting some local groups, causes, and nonprofits who could use year-round help.

ADVOCACY

Perhaps the best way to use your renewed political energy is putting it toward a cause you care about. For example, if you’re worried about how this year’s massive budget deficit might devastate healthcare in San Francisco, you might want to get involved with Coalition to Save Public Health (415-848-3611 ext. 3628, home.comcast.net/~mylon01/publichealth). Also check out nonprofits and grassroots groups working towards marriage equality, energy reform, or whatever pet issue you’re passionate about.

CITY GOVERNMENT

An even more direct way to be involved in local government is to volunteer inside City Hall, particularly with the San Francisco Board of Supervisors (1 Carlton B. Goodlett, SF. 415-554-5184, www.sfgov.org). Every supervisor has two aides, who in turn rely on donated labor to maintain the busy officials’ schedules and duties. To get involved, visit the Web site and fill out an application specifying your skills, availability, and preferred supervisors. Keep in mind four current supervisors once worked as staff or interns in these same offices, so this is a great way to get into politics while helping our government run more efficiently. It’s win-win.

Though SF might seem like a bicycle-friendly city, we’ve still got a lot of work to do, from promoting the bike as primary transportation to representing bicycle interests in local government and city planning. It’s easy to forget how important beautiful, open spaces are to a community until you don’t have them. But just imagine how different the Mission would be without Dolores Park, or the Lower Haight without Duboce. Support the maintenance, beautification, and continued improvement of these and other green spaces by volunteering with the Neighborhood Parks Council (451 Hayes, F. 415-621-3260, www.sfnpc.org). The Council welcomes everything from one-time feedback or participation in a scheduled work day to longer-term internships for youth 16-23 years old, and everything in between.

One of our favorite recent-ish developments on the Interwebs is the proliferation of Web sites connecting philanthropic types to specific causes — especially two SF-based organizations who work specifically with volunteers. Check out Chinatown-based Volunteermatch.org for a list of specific opportunities and a chance to upload your volunteer résumé — great for medium- to long-term volunteering — or former Best of the Bay winner One Brick (www.onebrick.org), which hosts an event calendar of upcoming volunteer events — great for one-time, short-term, and short-notice involvement.

Most important, we’d like to point out that community service, though incredibly important, is only one way to address our society’s ills. "It can be a Band-Aid approach to systemic problems," said Sup. Chris Daly. What we really need, he said, is "to demand more from elected leaders, for people to put themselves forward and take control of political institutions. There’s no greater service than keeping elected leaders accountable to the people they serve."

Don’t privatize cab permits

EDITORIAL In tough times, political leaders with no backbone for making hard decisions tend to look for easy, short-term fixes. And Mayor Gavin Newsom’s proposal to auction off taxicab permits to the highest bidder is just that — a quick fix with serious long-term problems. In fact, it amounts to the privatization of a lucrative public asset.

A bit of background: since 1978, when then-Sup. Quentin Kopp authored a measure called Proposition K, San Francisco has issued some 1,500 taxi permits, known as medallions, to working cab drivers. Under Prop. K, the medallions can’t be owned by corporations, and they can’t be bought and sold as speculative commodities. They’re owned by the city, and only people who actually drive cabs for a living can use them.

There’s a logic to that. The permits are valuable — a medallion holder not only has the right to drive a cab, he or she can lease that permit to other drivers for additional shifts. Since a taxi can be on the road 24 hours a day, the lease income is substantial, roughly $30,000 a year. But only active drivers get that benefit; nobody can hold a permit, sit at home (or work another job), and just collect that cash.

The process isn’t perfect. The waiting list for a medallion takes more than 10 years. Some medallion holders cling to their permits long after they should have retired (and thus keep driving when they should no longer be on the road). There’s no process for compensating a permit holder who becomes disabled.

But those are issues that can be addressed. The basic fact is that San Francisco has taken the position that the public benefit — a license to drive a cab for hire — should be given only to those who are using it. Prop. K prevents consolidation of ownership in the industry, prevents speculators from turning medallions into a new form of securities (which worked out so well with mortgages), and gives people who have spent 10 years or more driving a cab a chance to reap the full benefits of their work.

Newsom, however, sees those permits as a gold mine. If the city auctioned them off, they might bring $100,000 apiece. Under Newsom’s plan, much of that money would go to the city, although some would go to current medallion holders.

The plan is full of problems.

For one, it could completely change the cab business in San Francisco, shifting control of the industry away from drivers and giving it to big businesses and investors. Very few working drivers (who are lucky to clear $30,000 a year) could afford to buy permits, particularly at auction. So the first people in the market would be the cab companies, which for years have wanted the right to own and control the medallions. Private investors — wealthy individuals and institutions — would see the permits as an asset likely to appreciate, and would buy up medallions, then seek to raise the lease fees for drivers. The only way drivers could buy permits would be to seek the equivalent of mortgage loans — but the banks that handle that sort of loans typically require 20 percent down, putting many drivers out of the running. Unless, that is, some shadowy characters come along with cash loans — or unless the cab companies handle that payment, thereby getting further control).

Unless medallion ownership is limited to drivers, the entire process will get corrupted. People will drive for a minimal period of time, bid on medallions, then go into another line of work — and keep the medallion. Newsom’s office says he’s going to do that, but there are no details on the plan yet.

Cab drivers in the city talk about the need for security and retirement income. After years of driving with a medallion, they want the right to sell it for a chunk of cash. But under the current system, drivers are — and most of them like being — independent contractors.

Freelance writers, consultants, small business owners, and many others who are self-employed are responsible for their own retirement planning. Why should cab drivers get a special deal from the city?

Privatizing the permits is just a bad idea. Newsom promised last year — in writing — that he wouldn’t seek to change Prop. K. It’s infuriating to see him so quickly break that promise.

The supervisors should reject this proposal.

Preserving historic preservation

While most of us were glued to the inauguration in Washington, a significant battle has been brewing back at home over the city’s new Historic Preservation Commission. The commission was another of former Sup. Aaron Peskin’s parting gifts to the city, approved on the November 2008 ballot. It strengthens the city’s commitment to historic preservation and could become a powerful force against some of the most mindless acts of developers. It could, for example, have the authority to prevent the demolition of affordable rental housing in the name of pricey condos. It will certainly keep the city from allowing developers to bulldoze landmarks.

The mayor gets to appoint members to the panel, and the Board of Supervisors has to confirm those nominees. Most of the people Gavin Newsom has proposed are decent enough. But preservationists are up in arms over the nomination of Jonathan Perlman.

Perlman is an architect, but his critics say he utterly fails to meet the qualifications for the commission (PDF File). He’s well known in preservationist circles as the developer rep who sought to demolish the Harding Theater. The Harding is a historic building designed by the Reid Brothers. According to the organized, active group of Harding supporters:

the theater remains remarkably intact. In fact, the Harding is the most intact of the Reid Brothers theaters in San Francisco and still appears much as it did in the 1920s. The theater retains original seats and the fire curtain dating to the opening of the theater. The entrance, floor and aisle plan, balcony, proscenium arch, stage, and decorative ceiling remain intact, as well as significant plaster detail. The auditorium is unique in retaining an original sense of place from the “pre-talkie” days.

And yet, Perlman tried to argue that the place has little merit and that it was fine to turn it into condos. He wanted that done without even an environmental impact report. The Planning Commission and the supervisors have refused to go along.

Perlman refers to supporters of the Harding, who include the widely respected SF Heritage, as “obstructionists.” But as preservationist David Tornheim notes, “without the opponents’s ‘obstructionist tactics,’ the developer, with Mr. Perlman’s assistance, would have succeed in demolishing a certified historic building without environmental review.”

Peskin is lobbying against the nomination, which makes sense: Perlman’s record put him directly at odds with the intent of the new commission. The Rules Committee votes on this Jan. 22. It ought to be a no-brainer.

WASHINGTON DC — This inauguration is about being a witness. We’re here with millions of people, from average citizens to movie stars and politicians, a fraction of which have limited access to all the restricted seating.

It’s easy to feel unimportant. Much like the disenchanted voter who feels that his or her singular vote is worthless in relation to the masses, so too does standing in a sea of millions of onlookers. After all, we’re just two tourists from San Francisco here to witness history.

But when Anderson Cooper walked past us in a crowd and only a few people noticed and cheered, we got the feeling that we’re all equally unimportant and therefore we all can claim a certain amount of celebrity.
Earlier that afternoon, two middle-aged women from Houston stopped us to pose for a picture with them. We’re all special because we’re here to witness something much larger than ourselves.

All the locals who have friends in town are planning to attend the inaugural events. They admit it with a level of aloof interest, as though they need an excuse to find the gravity of it all enticing. There are also the locals who had long ago decided that the inaugural festivities were only for tourists and die-hards; complete with overwhelming crowds and extremely cold weather.

But the mood is infectious as momentum fills the streets. Everywhere you look there are giant scaffolding, fences and bleachers being erected. We can’t walk five feet without seeing police officers and Obama swag vendors and the roofs near the mall are all lined with snipers.

Dufty swings to the right

Yesterday was the new Board’s first test on two key issues and in both cases, Sup. Bevan Dufty provided Mayor Gavin Newsom with the swing vote he needed.

Dufty’s votes were further evidence that he will likely be swinging increasingly to the right, as the next mayoral race looms on the not too distant horizon.

First, Dufty joined Sups Michela Alioto-Pier, Carmen Chu and Sean Elsbernd, in voting not to override Mayor Gavin Newsom’s veto of legislation that would have required conditional use permits and hearings when housing units are being eliminated.

Then, he joined the mayor’s usual trio of allies to block an appeal by opponents of a mixed-use project at the corner of Valencia and 14th streets. The project includes 36 homes and three stores and is the first big test case of the new Market Octavia Plan. So, even though CU proponents pitched it as being only a case of seven parking spaces, everyone knew it was about a lot more than that.

At issue was the fact that the Planning Commission had decided to waive the plan’s limitation on construction of parking spaces to one space for every two units.

Opponents of the project argued that decreasing automobile dependency and associated harms, including global warming and traffic congestion, require the political will to stick to progressive policies developed over many years.

But Dufty argued that he did not believe this project is “precedent setting” as he went along with the Newsom administration’s top allies on the Board.

To her credit, Sup. Sophie Maxwell joined the progressive voting block on both these issues, despite having lost the Battle for Board President at the hands of the progressive faction. For a moment, we thought she wasn’t going to: Maxwell initially voted not to override Newsom’s veto. But then she rescinded her vote and voted against Newsom. So double kudos go to Maxwell.

It will be interesting to see if planning staff recommend conditional use permits for the Whole Foods on Market and Dolores and a new proposed condo on Market and Buchanan. If they do, then Dufty, who to his credit gave the project sponsor’s attorney David Silverman a hard time for his divide and conquer-style tactics, may find himself having to eat his “not precedent setting” comment.

And despite Dufty’s very public push back against Silverman, Jason Henderson, Vice President of the Hayes Valley Neighborhood Association, feels the D 8 Supervisor ultimately didn’t listen to his own constituents enough.

“Bevan’s giving too much weight to some very loud people who constantly pester him, Henderson said.

FREE MUSIC AND MOVIES

For a little extra routine effort, I’ve managed to make San Francisco’s library system my Netflix/GreenCine, rotating CD turntable, and bookstore, all rolled into one. And it’s all free.

If you’re a books-music-film whore like me, you find your home maxed out with piles of the stuff … and not enough extra cash to feed your habits. So I’ve decided to only buy my favorites and to borrow the rest. We San Franciscans have quite a library system at our fingertips. You just have to learn how to use it.

Almost everyone thinks of a library as a place for books. And that’s not wrong: you can read the latest fiction and nonfiction bestsellers, and I’ve checked out a slew of great mixology/cocktail recipe books when I want to try new drinks at home. I’ve hit up bios on my favorite musicians, or brought home stacks of travel books before a trip (they usually have the current year’s edition of at least one travel series for a given place, whether it be Fodor’s, Lonely Planet, or Frommer’s).

But there’s much more. For DVDs, I regularly check Rotten Tomatoes’ New Releases page (www.rottentomatoes.com/dvd/new_releases.php) for new DVD releases. Anything I want to see, I keep on a list and search www.sfpl.org for those titles every week. About 90 percent of my list eventually comes to the library, and most within a few weeks of the release date.

And such a range! I recently checked out the Oscar-nominated animated foreign film, Persepolis, the entire first season of Mad Men, tons of documentaries, classics (like a Cyd Charisse musical or Katherine Hepburn and Spencer Tracy’s catalog), even Baby Mama (sure, it sucked, but I can’t resist Tina Fey).

A music fanatic can find virtually every style, and even dig into the history of a genre. I’ve found CDs of jazz and blues greats, including Jelly Roll Morton, John Lee Hooker, Bessie Smith, Muddy Waters, kitschy lounge like Martin Denny and singer Julie London, and have satiated rap cravings with the latest Talib Kwali, Lyrics Born, Missy Elliott, T.I. or Kanye (I won’t tell if you won’t).

Warning: there can be a long "holds" list for popular new releases (e.g., Iron Man just came out and has about 175). When this happens, Just get in the queue — you can request as many as 15 items simultaneously online (you do have a library card, right?) You’ll get an e-mail when your item comes in and you can check the status of your list any time you log in. Keep DVDs a full seven days (three weeks for books and CDs) and return ’em to any branch you like.

I’ve deepened my music knowledge, read a broader range of books, and canceled GreenCine. Instead, I enjoy a steady flow of free shit coming my way each week. And if I get bored or the novelty of Baby Mama wears off, I return it and free up space in my mind (and on my shelf) for more. (Virginia Miller)

STYLE FOR A SONG

Shhh. The first rule about thrifting, to paraphrase mobsters and hardcore thrift-store shoppers, is don’t talk about thrifting — and that means the sites of your finest thrift scores. Diehard thrifters guard their favorite shops with jealous zeal: they know exactly what it’s like to wade through scores of stained T-shirts, dress-for-success suits, and plastic purses and come up with zilcherooni. They also know what it’s like to ascend to thrifter nirvana, an increasingly rarified plane where vintage Chanel party shoes and cool dead-stock Western wear are sold for a song.

Friendships have been trashed and shopping carts upended in the revelation of these much-cherished thrift stores, where the quest for that ’50s lamb’s fur jacket or ’80s acid-washed zipper jeans — whatever floats your low-budg boat — has come to a rapturous conclusion. It’s a war zone, shopping on the cheap, out there — and though word has it that the thrifting is excellent in Vallejo and Fresno, our battle begins at home. When the sample sales, designer runoff outlets, resale dives, and consignment boutiques dry up, here’s where you’ll find just what you weren’t looking for — but love, love, love all the same.

Come for the writer’s own giveaways (you can bequeath the funds raised to any number of local nonprofits), and leave with the rattan couches, deco bureaus, records, books and magazines, and an eccentric assortment of clothing and housewares. I’m still amazed at the array of intriguing junk that zips through this spot, but act fast or you’ll miss snagging that Victorian armoire.

Goodwill As-Is Store, 86 11th St., SF. (415) 575-2197, www.sfgoodwill.org. This is the archetype and endgamer of grab-and-tumble thrifting. We’re talking bins, people — bins of dirt cheap and often downright dirty garb that the massive Goodwill around the corner has designated unsuitable, for whatever reason. Dive into said bins, rolled out by your, ahem, gracious Goodwill hosts throughout the day, along with your competition: professional pickers for vintage shops, grabby vintage people, and ironclad bargain hunters. They may not sell items by the pound anymore — now its $2.25 for a piece of adult clothing, 50 cents to $1 for babies’ and children’s garb, $4 for leather jackets, etc. — but the sense of triumph you’ll feel when you discover a tattered 1930s Atonement-style poison-ivy green gown, or a Dr. Pimp-enstein rabbit-fur patchwork coat, or cheery 1950s tablecloths with negligible stainage, is indescribable.

Goodwill Industries, 3801 Third St., SF. (415) 641-4470, www.sfgoodwill.org Alas, not all Goodwills are created equal: some eke out nothing but stale mom jeans and stretched-out polo shirts. But others, like this Hunter’s Point Goodwill, abound with on-trend goodies. At least until all of you thrift-hungry hordes grab my junk first. Tucked into the corner of a little strip mall, this Goodwill has all those extremely fashionable hipster goods that have been leached from more populated thrift pastures or plucked by your favorite street-savvy designer to "repurpose" as their latest collection: buffalo check shirts, wolf-embellished T-shirts, Gunne Sax fairy-princess gowns, basketball jerseys, and ’80s-era, multicolored zany-print tops that Paper Rad would give their beards for.

Salvation Army, 1500 Valencia, SF. (415) 643-8040, www.salvationarmyusa.org. The OG of Mission District thrifting, this Salv has been the site of many an awesome discovery. Find out when the Army puts out the new goods. The Salvation soldiers may have cordoned off the "vintage" — read: higher priced — items in the store within the store, but there are still plenty of old books, men’s clothing, and at times hep housewares and Formica kitchen tables to be had: I adore the rainbow Mork and Mindy parka vest I scored in the boys’ department, as well as my mid-century-mod mustard-colored rocker.

Savers, 875 Main, Redwood City. (650) 364-5545, www.savers.com When the ladies of Hillsborough, Burlingame, and the surrounding ‘burbs shed their oldest, most elegant offerings, the pickings can’t be beat at this Savers. You’ll find everything from I. Magnin cashmere toppers, vintage Gucci tweed, and high-camp ’80s feather-and-leather sweaters to collectible dishware, antique ribbons, and kitsch-cute Holly Hobbie plaques. Strangest, oddly covetable missed-score: a psychiatrist’s couch.

Thrift Town, 2101 Mission, SF. (415) 861-1132, www.thrifttown.com. When all else fails, fall back on this department store-sized megalith. Back in the day, thrift-oldsters tell me, they’d dig out collectible paintings and ’50s-era bikes. Now you’ll have to grind deeply to land those finds, though they’re here: cute, mismatched, mid-century chairs; the occasional designer handbag; and ’60s knit suits. Hint: venture into less picked-over departments like bedding. (Kimberly Chun)

Go to Rainbow Grocery early and hit the farmers markets late. Rainbow has cheap and half-price bins in the bread and produce sections — but you wouldn’t know it if you’re a late-riser. Get there shortly after doors open at 9 a.m. for the best deals.

By the end of the day, many vendors at farmers markets are looking to unload produce rather than pack it up, so it’s possible to score great deals if you’re wandering around during the last half hour of the market. Then there’s the Grocery Outlet (2001 Fourth St., Berkeley and 2900 Broadway, Oakland, www.groceryoutlets.com), which puts Wal-Mart to shame. This is truly the home of low-cost living. Grocery Outlet began in 1946 in San Francisco when Jim Read purchased surplus government goods and started selling them. Now Grocery Outlets are the West Coast’s version of those dented-can stores that sell discounted food that wasn’t ready for prime-time, or perhaps spent a little too long in the limelight.

Be prepared to eat what you find — options range from name brands with trashed labels to foodstuffs you’ve never seen before — but there are often good deals on local breads and cheeses, and their wine section will deeply expand you Two-Buck Chuck cellar. Don’t be afraid of an occasional corked bottle that you can turn into salad dressing, and be sure to check the dates on anything perishable. The Grocery Outlet Web site (which has the pimpest intro music ever) lists locations and ways to sign up for coupons and download a brochure on how to feed your family for $3 a day. LIVE MUSIC FOR NOTHING — AND KICKS FOR FREE

Music should be free. Everyone who has downloaded music they haven’t been given or paid for obviously believes this, though we haven’t quite made it to that ideal world where all professional musicians are subsidized — and given health care — by the government or other entities. But live, Clive? Where do can you catch fresh, live sounds during a hard-hitting, heavy-hanging economic downturn? Intrepid, impecunious sonic seekers know that with a sharp eye and zero dough, great sounds can be found in the oddest crannies of the city. You just need to know where to look, then lend an ear. Here are a few reliables — occasional BART station busks and impromptu Ocean Beach shows aside.

Some of the best deals — read: free — on world-class performers happen seasonally: in addition to freebie fests like Hardly Strictly Bluegrass every October and the street fairs that accompanying in fair weather, there’s each summer’s Stern Grove Festival. Beat back the Sunset fog with a picnic of bread, cheese, and cheap vino, though you gotta move fast to claim primo viewing turf to eyeball acts like Bettye Lavette, Seun Kuti and Egypt 80, and Allen Toussaint. Look for the 2009 schedule to be posted at www.sterngrove.org May 1.

Another great spot to catch particularly local luminaries is the Yerba Buena Gardens Festival, which runs from May to October. Rupa and the April Fishes, Brass Menazeri, Marcus Shelby Trio, Bayonics, and Omar Sosa’s Afreecanos Quintet all took their turn in the sun during the Thursday lunchtime concerts. All year around, shopkeeps support sounds further off the beaten path — music fans already know about the free, albeit usually shorter, shows, DJ sets, and acoustic performances at aural emporiums like Amoeba Music (www.amoeba.com) and Aquarius Records (www.aquariusrecords.org). Many a mind has been blown by a free blast of new sonics from MIA or Boris amid the stacks at Amoeba, the big daddy in this field, while Aquarius in-stores define coziness: witness last year’s intimate acoustic hootenanny by Deerhoof’s Satomi and Tenniscoats’ Saya as Oneone. Less regular but still an excellent time if you happen upon one: Adobe Books Backroom Gallery art openings (adobebooksbackroomgallery.blogspot.com), where you can get a nice, low-key dose of the Mission District’s art and music scenes converging. Recent exhibition unveilings have been topped off by performances by the Oh Sees, Boner Ha-chachacha, and the Quails.

Still further afield, check into the free-for-all, quality curatorial efforts at the Rite Spot (www.ritespotcafe.net), where most shows at this dimly lit, atmospheric slice of old-school cabaret bohemia are as free as the breeze and as fun as the collection of napkin art in back: Axton Kincaid, Brandy Shearer, Kitten on the Keys, Toshio Hirano, and Yard Sale have popped up in the past. Also worth a looky-loo are Thee Parkside‘s (www.theeparkside.com) free Twang Sunday and Happy Hour Shows: a rad time to check out bands you’ve never heard of but nonetheless pique your curiosity: Hukaholix, hell’s yeah! And don’t forget: every cover effort sounds better with a pint — all the better to check into the cover bands at Johnny Foley’s (www.johnnyfoleys.com), groove artists at Beckett’s Irish Pub in Berkeley (www.beckettsirishpub.com), and piano man Rod Dibble and his rousing sing-alongs at the Alley in Oakland (510-444-8505). THE CHEAPEST WAY TO GET AROUND TOWN

Our complex world often defies simple solutions. But there is one easy way to save money, get healthy, become more self-sufficient, free up public resources, and reduce your contribution to air pollution and global warming: get around town on a bicycle.

It’s no coincidence that the number of cyclists on San Francisco streets has increased dramatically over the last few years, a period of volatile gasoline prices, heightened awareness of climate change, poor Muni performance, and economic stagnation.

On Bike to Work Day last year, traffic counts during the morning commute tallied more bicycles than cars on Market Street for the first time. Surveys commissioned by the San Francisco Bicycle Coalition show that the number of regular bike commuters has more than doubled in recent years. And that increase came even as a court injunction barred new bike projects in the city (see "Stationary biking," 5/16/07), a ban that likely will be lifted later this year, triggering key improvements in the city’s bicycle network that will greatly improve safety.

Still not convinced? Then do the math.

Drive a car and you’ll probably spend a few hundred dollars every month on insurance, gas, tolls, parking, and fines, and that’s even if you already own your car outright. If you ride the bus, you’ll pay $45 per month for a Fast Pass while government will pay millions more to subsidize the difference. Riding a bike is basically free.

Free? Surely there are costs associated with bicycling, right? Yeah, sure, occasionally. But in a bike-friendly city like San Francisco, there are all kinds of opportunities to keep those costs very low, certainly lower than any other transportation alternative except walking (which is also a fine option for short trips).

There are lots of inexpensive used bicycles out there. I bought three of my four bicycles at the Bike Hut at Pier 40 (www.thebikehut.com) for an average of $100 each and they’ve worked great for several years (my fourth bike, a suspension mountain bike, I also bought used for a few hundred bucks).

Local shops that sell used bikes include Fresh Air Bicycles, (1943 Divisidero, www.fabsf.com) Refried Cycles (3804 17th St., www.refriedcycles,com/bicycles.htm), Karim Cycle (2800 Telegraph., Berkeley, www.teamkarim.com/bikes/used/) and Re-Cycles Bicycles (3120 Sacramento, Berkeley, www.recyclesbicycles.com). Blazing Saddles (1095 Columbus, www.blazingsaddles.com) sells used rental bikes for reasonable prices. Craigslist always has listings for dozens of used bikes of all styles and prices. And these days, you can even buy a new bike for a few hundred bucks. Sure, they’re often made in China with cheap parts, but they’ll work just fine.

Bikes are simple yet effective machines with a limited number of moving parts, so it’s easy to learn to fix them yourself and cut out even the minimal maintenance costs associated with cycling. I spent $100 for two four-hour classes at Freewheel Bike Shop (1920 Hayes and 914 Valencia, www.thefreewheel.com) that taught me everything I need to know about bike maintenance and includes a six-month membership that lets me use its facilities, tools, and the expertise of its mechanics. My bikes are all running smoother than ever on new ball bearings that cost me two bucks per wheel, but they were plenty functional even before.

There are also ways to get bike skills for free. Sports Basement (www.sportsbasement.com) offers free bicycle maintenance classes at both its San Francisco locations the first Tuesday of every month from 6:30-7:30 p.m. Or you can turn to the Internet, where YouTube has a variety of bike repair videos and Web sites such as www.howtofixbikes.com can lead you through repairs.

The nonprofit The Bike Kitchen (1256 Mission, www.thebikekitchen.org) on Mission Street offers great deals to people who spend $40 per year for a membership. Volunteer your time through the Earn-a-Bike program and they’ll give you the frame, parts, and skills to build your own bike for free.

But even in these hard economic times, there is one purchase I wouldn’t skimp on: spend the $30 — $45 for a good U-lock, preferably with a cable for securing the wheels. Then you’re all set, ready to sell your car, ditch the bus, and learn how easy, cheap, fast, efficient, and fun it is to bicycle in this 49-square-mile city. (Steven T. Jones)

LOW-COST HEALTH CARE

When money’s tight, healthcare tends to be one of the first costs we cut. But that can be a bad idea, because skimping on preventive care and treatment for minor issues can lead to much more expensive and serious (and painful) health issues later. Here is our guide to Bay Area institutions, programs, and clinics that serve the under- and uninsured.

One of our favorite places is the Women’s Community Clinic (2166 Hayes, 415-379-7800, www.womenscommunityclinic.org), a women-operated provider open to anyone female, female-identified, or female-bodied transgender. This awesome 10-year-old clinic offers sexual and reproductive health services — from Pap smears and PMS treatment to menopause and infertility support — to any SF, San Mateo, Alameda, or Marin County resident, and all on a generous sliding scale based on income and insurance (or lack thereof). Call for an appointment, or drop in on Friday mornings (but show up at 9:30 a.m. because spots fill up fast).

A broader option (in terms of both gender and service) is Mission Neighborhood Center (main clinic at 240 Shotwell. 415-552-3870, www.mnhc.org, see Web site for specialty clinics). This one-stop health shop provides primary, HIV/AIDS, preventive, podiatry, women’s, children’s, and homeless care to all, though its primary focus is on the Latino/Hispanic Spanish-speaking community. Insurance and patient payment is accepted, including a sliding scale for the uninsured (no one is denied based on inability to pay). This clinic is also a designated Medical Home (or primary care facility) for those involved in the Healthy San Francisco program.

Contrary to popular belief, Healthy San Francisco (www.healthysanfrancisco.org) is not insurance. Rather, it’s a network of hospitals and clinics that provide free or nearly free healthcare to uninsured SF residents who earn at or below 300 percent of the federal poverty level (which, at about $2,600 per month, includes many of us). Participants choose a Medical Home, which serves as a first point-of-contact. The good news? HSF is blind to immigration status, employment status, and preexisting medical conditions. The catch? The program’s so new and there are so many eligible residents that the application process is backlogged — you may have a long wait before you reap the rewards. Plus, HSF only applies within San Francisco.

Some might consider mental health less important than that of the corporeal body, but anyone who’s suffered from depression, addiction, or PTSD knows otherwise. Problem is, psychotherapy tends to be expensive — and therefore considered superfluous. Not so at Golden Gate Integral Counseling Center (507 Polk. 415-561-0230, www.goldengatecounseling.org), where individuals, couples, families, and groups can get long- and short-term counseling for issues from stress and relationships to gender identity, all billed on a sliding scale.

Other good options

American College of Traditional Chinese Medicine (450 Connecticut, 415-282-9603, actcm.edu). This well-regarded school provides a range of treatments, including acupuncture, cupping, tui ma/shiatsu massage, and herbal therapy, at its on-site clinics — all priced according to a sliding scale and with discounts for students and seniors. The college also sends interns to specialty clinics around the Bay, including the Women’s Community Clinic, Haight Ashbury Free Medical Clinic, and St. James Infirmary.

St. James Infirmary (1372 Mission. 415-554-8494, www.stjamesinfirmary.org). Created for sex-workers and their partners, this Mission District clinic offers a range of services from primary care to massage and self-defense classes, for free. Bad ass.

Free Print Shop (www.freeprintshop.org): This fantabulous Webs site has charts showing access to free healthcare across the city, as well as free food, shelter, and help with neighborhood problems. If we haven’t listed ’em, Free Print Shop has. Tell a friend.

Native American Health Center (160 Capp, 415-621-8051, www.nativehealth.org). Though geared towards Native Americans, this multifaceted clinic (dental! an Oakland locale, and an Alameda satellite!) turns no one away. Services are offered to the under-insured on a sliding scale as well as to those with insurance.

SF Free Clinic (4900 California, 415-750-9894, www.sffc.org). Those without any health insurance can get vaccinations, diabetes care, family planning assistance, STD diagnosis and treatment, well child care, and monitoring of acute and chronic medical problems.

Haight Ashbury Free Clinics (558 Clayton. 415-746-1950, www.hafci.org): Though available to all, these clinics are geared towards the uninsured, underinsured "working poor," the homeless, youth, and those with substance abuse and/or mental health issues. We love this organization not only for its day-to-day service, but for its low-income residential substance abuse recovery programs and its creation of RockMed, which provides free medical care at concerts and events. THE BEST HOMELESS SHELTERS

There’s no reason to be ashamed to stay in the city’s homeless shelters — but proceed with awareness. Although most shelters take safety precautions and men and women sleep in separate areas, they’re high-traffic places that house a true cross-section of the city’s population.

The city shelters won’t take you if you just show up — you have to make a reservation. In any case, a reservation center should be your first stop anyway because they’ll likely have other services available for you. If you’re a first-timer, they’ll want to enter you into the system and take your photograph. (You can turn down the photo-op.) Reservations can be made for up to seven days, after which you’ll need to connect with a case manager to reserve a more permanent 30- or 60-day bed.

The best time to show up is first thing in the morning when beds are opening up, or late at night when beds have opened up because of no-show reservations. First thing in the morning means break of dawn — people often start lining up between 4 a.m. and 6 a.m. for the few open beds. Many people are turned away throughout the day, although your chances are better if you’re a woman.

You can reserve a bed at one of several reservation stations: 150 Otis, Mission Neighborhood Resource Center (165 Capp St.), Tenderloin Resource Center (187 Golden Gate), Glide (330 Ellis), United Council (2111 Jennings), and the shelters at MSC South (525 Fifth St.) and Hospitality House (146 Leavenworth). If it’s late at night, they may have a van available to give you a ride to the shelter. Otherwise, bus tokens are sometimes available if you ask for one — especially if you’re staying at Providence shelter in the Bayview-Hunters Point District.

They’ll ask if you have a shelter preference — they’re all a little different and come with good and bad recommendations depending on whom you talk to. By all accounts, Hospitality House is one of the best — it’s small, clean, and well run. But it’s for men only, as are the Dolores Street Community Services shelters (1050 S. Van Ness and 1200 Florida), which primarily cater to Spanish-speaking clients.

Women can try Oshun (211 13th St.) and A Woman’s Place (1049 Howard) if they want a men-free space. If kids are in tow, Compass Family Services will set you up with shelter and put you on a waiting list for housing. (A recent crush of families means a waiting list for shelters also exists.) People between 18 and 24 can go to Lark Inn (869 Ellis). The Asian Woman’s Shelter specializes in services for Asian-speaking women and domestic violence victims (call the crisis line 877-751-0880). IMPRESS A DATE WITH DINNER UNDER $50

You’ve got a date this weekend, which you’re feeling pretty good about, but only $50 to spend, which feels … not so good. Where should you go?

You’ll appear in-the-know at the underrated Sheba Piano Lounge (1419 Fillmore, www.shebalounge.com) on lower Fillmore Street, right in the middle of the burgeoning jazz revival district. Sheba was around long before Yoshi’s, offering live jazz (usually piano, sometimes a vocalist) and some of the best Ethiopian food in the city in a refined, relaxed lounge setting. Sure, they’ve got Americanized dishes, but skip those for the traditional Ethiopian menu. Sample multiple items by ordering the vegetarian platter ($13) or ask for a mixed meat platter, which is not on the menu ($16 last time I ordered it). One platter is more than enough for two, and you can still afford a couple of cocktails, glasses of wine or beer, or even some Ethiopian honey wine (all well under $10). Like any authentic Ethiopian place I’ve eaten in, the staff operates on Africa time, so be prepared to linger and relax.

It’s a little hipster-ish with slick light fixtures, a narrow dining room/bar, and the increasingly common "communal table" up front, but the Mission District’s Bar Bambino (2931 16th St., www.barbambino.com) offers an Italian enoteca experience that says "I’ve got some sophistication, but I like to keep it casual." Reserve ahead for tables because there aren’t many, or come early and sit at the bar or in the enclosed back patio and enjoy an impressive selection of Italian wines by the glass ($8–$12.50). For added savings with a touch of glam, don’t forget their free sparkling water on tap. It’s another small plates/antipasti-style menu, so share a pasta ($10.50–$15.50), panini ($11.50–$12.50), and some of their great house-cured salumi or artisan cheese. Bar Bambino was just named one of the best wine bars in the country by Bon Apetit, but don’t let that deter you from one of the city’s real gems.

Nothing says romance (of the first date kind) like a classic French bistro, especially one with a charming (heated) back patio. Bistro Aix (3340 Steiner, www.bistroaix.com) is one of those rare places in the Marina District where you can skip the pretension and go for old school French comfort food (think duck confit, top sirloin steak and frites, and a goat cheese salad — although the menu does stray a little outside the French zone with some pasta and "cracker crust pizza." Bistro Aix has been around for years, offering one of the cheapest (and latest — most end by 6 or 7 p.m.) French prix fixe menus in town (Sunday through Thursday, 6–8 p.m.) at $18 for two courses. This pushes it to $40 for two, but still makes it possible to add a glass of wine, which is reasonably priced on the lower end of their Euro-focused wine list ($6.25–$15 a glass).

FREE YOGA

You may be broke, but you can still stay limber. San Francisco is home to scores of studios and karmically-blessed souls looking to do a good turn by making yoga affordable for everyone.

One of the more prolific teachers and donation-based yoga enthusiasts is Tony Eason, who trained in the Iyengar tradition. His classes, as well as links to other donation-based teachers, can be found at ynottony.com. Another great teacher in the Anusara tradition is Skeeter Barker, who teaches classes for all levels Mondays and Wednesdays from 7:45 to 9:15 p.m. at Yoga Kula, 3030a 16th St. (recommended $8–$10 donation).

Sports Basement also hosts free classes every Sunday at three stores: Bryant Street from 1 to 2 p.m., the Presidio from 11a.m. to noon, and Walnut Creek 11 a.m. to noon. Bring your own mat.

HOW TO KEEP YOUR APARTMENT

So the building you live in was foreclosed. Or you missed a few rent payments. Suddenly there’s a three-day eviction notice in your mailbox. What now?

Don’t panic. That’s the advice from Ted Gullicksen, executive director of the San Francisco Tenants Union. Tenants have rights, and evictions can take a long time. And while you may have to deal with some complications and legal issues, you don’t need to pack your bags yet.

Instead, pick up the phone and call the Tenants Union (282-6622, www.sftu.org) or get some professional advice from a lawyer.

The three-day notice doesn’t mean you have to be out in three days. "But it does mean you will have to respond to and communicate with the landlord/lady within that time," Gullicksen told us.

It’s also important to keep paying your rent, Gullicksen warned, unless you can’t pay the full amount and have little hope of doing so any time soon.

"Nonpayment of rent is the easiest way for a landlord to evict a tenant," Gullicksen explained. "Don’t make life easier for the landlady who was perhaps trying to use the fact that your relatives have been staying with you for a month as grounds to evict you so she can convert your apartment into a pricey condominium."

There are, however, caveats to Gullicksen’s "always pay the rent" rule: if you don’t have the money or you don’t have all the money.

"Say you owe $1,000 but only have $750 when you get the eviction notice," Gullicksen explained. "In that case, you may want to not pay your landlord $750, in case he sits on it but still continues on with the eviction. Instead, you might want to put the money to finding another place or hiring an attorney."

A good lawyer can often delay an eviction — even if it’s over nonpayment or rent — and give you time to work out a deal. Many landlords, when faced with the prospect of a long legal fight, will come to the table. Gullicksen noted that the vast majority of eviction cases end in a settlement. "We encourage all tenants to fight evictions," he said. The Tenants Union can refer you to qualified tenant lawyers.

These days some tenants who live in buildings that have been foreclosed on are getting eviction notices. But in San Francisco, city officials are quick to point out, foreclosure is not a legal ground for eviction.

Another useful tip: if your landlord is cutting back on the services you get — whether it’s a loss of laundry facilities, parking, or storage space, or the owner has failed to do repairs or is preventing you from preventing you from "the quiet enjoyment of your apartment" — you may be able to get a rent reduction. With the passage of Proposition M in November 2008 tenants who have been subjected to harassment by their landlords are also eligible for rent reductions. That involves a petition to the San Francisco Rent Stabilization and Arbitration Board (www.sfgov.org/site/rentboard_index.asp).

Gullicksen also recommends that people who have lost their jobs check out the Eviction Defense Collaborative (www.evictiondefense.org).

"They are mostly limited to helping people who have temporary shortfalls," Gullicksen cautioned. But if you’ve lost your job and are about to start a new one and are a month short, they can help. (Sarah Phelan)

OUT OF WORK? HERE’S STEP ONE

How do you get your unemployment check?

"Just apply for it."

That’s the advice of California’s Employment Development Department spokesperson Patrick Joyce.

You may think you aren’t eligible because you may have been fired or were only working part-time, but it’s still worth a try. "Sometimes people are ineligible, but sometimes they’re not," Joyce said, explaining that a lot of factors come into play, including your work history and how much you were making during the year before you became unemployed.

"So, simply apply for it — if you don’t qualify we’ll tell you," he said. "And if you think you are eligible and we don’t, you can appeal to the Unemployment Insurance Appeals Board."

Don’t wait, either. "No one gets unemployment benefits insurance payments for the first week they are unemployed," Joyce explained, referring to the one-week waiting period the EDD imposes before qualified applicants can start collecting. "So you should apply immediately."

Folks can apply by filling out the unemployment insurance benefits form online or over the phone. But the phone number is frequently busy, so online is the best bet.

Six aren’t enough

The historic Jan. 8 vote electing Sup. David Chiu as president of the Board of Supervisors — rare for its elevation of a freshman to the post and unprecedented for a Chinese American — clearly illustrates the ideological breakdown of the new board.

The six supervisors who claim membership in the progressive movement (Chris Daly, Ross Mirkarimi, David Campos, John Avalos, Eric Mar, and Chiu) gave Chiu the presidency after their efforts to give it to Mirkarimi or Avalos fell short, while the other five supervisors voted for Sup. Sophie Maxwell in each of the seven rounds, refusing to support any of the progressive picks.

But there are limits to what a bare majority of supervisors can do in San Francisco, particularly when the mayor is threatening vetoes and the city is wrestling with a budget deficit of gargantuan proportions. Overriding a mayoral veto or approving some emergency measures requires eight votes.

So the first question is whether Mirkarimi and Daly can come together after their split divided progressives and led to Chiu as a compromise candidate. But the second, more important, question for progressives is whether they can attract swing votes such as Maxwell and Bevan Dufty when the need arises.

The answers to those questions could start coming immediately as supervisors consider proposals to close a looming $575 million budget gap, including the proposal for a special election on revenue measures in June. Mayor Gavin Newsom opposes that election, so the board would have to muster eight votes in the next month to move forward with it.

They might even need more than that. A confidential memo to supervisors and the mayor by the City Attorney’s Office that was obtained by the Guardian sorts out the complex requirements needed to approve new taxes, including the requirement of unanimous board approval to place tax measures that can be passed with a simple majority vote on the ballot this year.

So President Chiu, who pledges to bring his colleagues together, certainly has his work cut out for him.

 

POLITICS AND POLICY

Achieving a unanimous vote on anything significant or controversial seems impossible right now. Mirkarimi is unhappy with Daly for thwarting his presidential ambitions; Maxwell and Dufty are unhappy with progressives for keeping her out of their club; and Chiu must quickly learn his new job during a time of unprecedented turmoil.

Chiu told his colleagues that he was “incredibly humbled” by an election that he didn’t think he’d win, and said that he is “acutely aware that I am new to the institution and the body.” But observers say Chiu’s temperament, intelligence, and connections to both the business community and the progressive movement could serve the city well right now.

“I think Chiu is a great choice. He has the humility that will help him,” outgoing Sup. Jake McGoldrick told the Guardian.

This compromise pick for president was praised by all sides, from the progressive coalition that feted him after the vote at a party at the SoMa club Temple. Rob Black, government affairs director for the San Francisco Chamber of Commerce, told reporters that “David seems to be someone who is very willing to listen and willing to ask questions.”

“We have a progressive supervisor running the board,” Mirkarimi told the Guardian as he walked back to his office following the vote. Or, as Daly told us, “In the end, the progressive coalition stuck together and I’m happy about that.”

Walking back to Room 200 after the vote, Newsom told reporters that Chiu was “an outstanding choice” who represents “a fresh air of progress.” Asked whether he expects to have a better working relationship with Chiu than with outgoing president Aaron Peskin, Newsom replied, “That’s a gross understatement.”

“We’re looking forward to working with the new Board of Supervisors,” Newsom spokesperson Nathan Ballard told the Guardian after the vote. “The mayor has a long relationship with David Chiu. In fact, he was on our short list to be named assessor just a few years ago.”

Yet at the progressive party that night, Chiu sounded like a rock-solid member of that group, promising to help Mirkarimi with police reform, Campos with protecting undocumented city residents, Mar with strengthening city ties to the schools, and Avalos with safeguarding progressive budget priorities.

“I think this is the best outcome we could have,” Mirkarimi told the Guardian shortly after Chiu was elected. “I was the deciding vote that delivered Sup. David Chiu, the first Asian American president of the board. That doesn’t mean that the seasoned experience of Maxwell and myself wasn’t hard to pass by.”

In fact, both Dufty and Maxwell groused about the progressive bloc’s opposition to Maxwell, noting her positions on issues such as public power, affordable housing, and transportation issues. “The people that voted for me did so because they felt I would at least listen to them,” Maxwell told us, expressing frustration at not being accepted “by the board’s progressive clique” which, she noted, “are all males.”

“I think David will be great,” Dufty told the Guardian. “Obviously there was a desire to have someone strongly aligned with the progressive movement. I think it’s a mystery that Sophie isn’t considered part of the progressive movement.”

Progressives are going to have to work at resolving those differences if they are going to play a leadership role in the midyear budget cuts and prevent an expansion of the bloc of five supervisors who stuck with Maxwell and often align with the mayor.

“There has been tension between Ross and myself, but also between Sophie and Ross,” Daly told us. “Sophie is feeling that she might be a progressive, too. And some of the things we do on the board need eight votes. The rift between Ross and I is little. The real question is, when do we get Bevan and Sophie back?”

After fending off a progressive challenger in his reelection bid two years ago, Dufty seemed to move to the left, only to return to Newsom’s centrist faction — which mixes social liberalism with fiscal conservatism — in the last year. He prevented progressives from being able to override a mayoral veto of their decision to cancel $1 million in funding to Newsom’s Community Justice Center. And on Jan. 6, the old board delayed a vote on a mayoral veto of an ordinance that amends the Planning Code to require Conditional Use hearings and permits for any elimination of existing dwelling units through mergers, conversions, or demolitions of residential units, something sought by the tenant groups that are an important part of the progressive coalition.

Those issues, and the thicket that is the budget debate, illustrate what Daly admitted to us last week: “We can’t run this city with six votes.”

 

THE BUDGET MESS

The most pressing problem facing the new board is the budget, which requires $125 million in midyear cuts for the current fiscal year and will be an estimated $575 million out of balance for the fiscal year that begins in June. Chiu’s first move to deal with it — one lauded by progressives — was to name Avalos as budget chair.

“John Avalos has more experience on budget issues than me,” Daly, who chaired the Budget Committee for two years, said of his former board aide. But even Avalos was awestruck by the tsunami of bad budget news hitting the city, telling us, “I was visibly shaken.”

Mirkarimi and Elsbernd, the Budget Committee’s two other current members, also admit they face a daunting task.

“We can’t put a Band-Aid on the problem,” Elsbernd told the board last week. “This is not just about San Francisco now, but about San Francisco 20 years from now. We need to think about the next generation.”

Mirkarimi agrees with Elsbernd, at least in terms of the enormity of the problem.

“We cannot be incrementalist. We can’t dance around the edges,” Mirkarimi told his colleagues, shortly after making the surprise announcement that he’s expecting a child in April with Venezuelan soap opera star Eliana López, who he’s dated since meeting her last year at a Green Party conference in Brazil. Elsbernd and his wife are also expecting their first child.

Progressives strongly argue that such a large budget deficit can’t be closed with spending cuts alone, so one of Peskin’s final acts was to create legislation calling a special election for June 2 and having supervisors hold hearings over the next month to choose from a variety of revenue measures, but Newsom and the business community opposed the move.

“Basically, it’s not fully baked. It will take a citywide coalition (à la Prop. A) to win something like this and the coalition just hasn’t been built yet,” Ballard told the Guardian. Even Mirarimi echoed the sentiment, telling the Guardian, “I’m not opposed to a June election, but you can’t put something on the June ballot that’s half-baked because I doubt we could win in November if we put something half-baked on in June. My preference is that we work harder to create alliances to assure a healthy chance of getting something on the ballot and delivering a victory.”

Yet many progressives and labor leaders say it’s important to bring in new revenue as soon as possible, particularly because the cuts required by the current budget deficit would slash about half the city’s discretionary spending and devastate important initiatives like offering health coverage to all San Franciscans.

“For Healthy San Francisco to survive, the Department of Public Health has to have a minimum level of funding,” said Robert Haaland, a labor representative with the public employee union SEIU Local 1021. “Given the cuts that have been proposed, it’s not going to survive.”

While Peskin was criticized for acting prematurely, the City Attorney’s Office memo indicated that he couldn’t have waited and still allowed supervisors to play the lead role in determining what ended up on the June ballot. The memo was requested by Daly.

“In response to your specific inquiry about maximizing the amount of time a committee could deliberate the underlying measures and ensuring that the Board would have enough time to override a Mayoral veto, the emergency ordinance and the resolution calling for the special election should be introduced today,” the City Attorney’s Office wrote Jan. 6, the day Peskin introduced his revenue package.

Even then, supervisors would need to vote to waive certain election procedures, such as the 30-day hold for proposed ballot measures, and to move expeditiously forward with hearings, selection of the tax measures, and preparation of findings related to the special election and declaration of fiscal emergency.

The City Attorney’s Office wrote that the package needs final approval by Feb. 17. “We recommend that to meet this deadline, the Board adopt the resolution at its January 27 meeting and that the Mayor sign the resolution no earlier than February 2,” they wrote.

But Newsom has indicated that he would veto it, thus requiring eight supervisors to override. “Aaron had the right to do what he did, but in some ways he rushed the discussion, so it’s been a bit rockier than it otherwise might have been,” Dufty told us, noting that he’s still open to supporting a June ballot measure. “There is no way to avoid spending cuts, and we need more revenues and more givebacks from public employees … I think labor is spending a significant amount of time with the mayor, and he’s making a strong effort to work with the board. I’m trying to encourage us all to work together to the maximum extent possible.”

In fact, San Francisco Labor Council director Tim Paulson told the Guardian he couldn’t talk about the tax measures yet because of intense ongoing discussions. Ballard said Newsom might be open to tax measures in November, telling the Guardian, “Ideally we could do it all by streamlining government, reducing spending, etc. But the mayor lives in the real world and so he is open to the possibility of a revenue measure with a broad base of support.”

So, can the new board president help coalesce the broad base of support that he’ll need to avoid cuts that would especially hurt the progressive base of unions, tenants, social service providers, affordable housing activists, and others who believe that government plays an important role in addressing social problems and inequities?

“In light of the global meltdown, national slowdown, local crisis, and largest budget deficit in history, I believe this board understands the importance of unity and working together,” Chiu told his colleagues. “We don’t have time for the politics of personality when we have the highest murder rate in 10 years, when businesses are failing, and the budget deficit grows exponentially.”

Will supervisors support SF’s parking policies?

The new San Francisco Board of Supervisors holds its first regular meeting today, following last week’s big leadership vote. The agenda is pretty sparse, but there are two items that will be a big test of the board’s progressive leadership and values.
The first is a veto override on legislation requiring conditional use permits and hearings when housing units are being eliminated. Given that existing units are always the most valuable, this vote will gauge how much support tenants and affordable housing advocates have on the new board – particularly with the potential swing votes of Bevan Dufty and Sophie Maxwell, who the progressive majority would need to override the veto.
The second is an appeal by opponents of a mixed-use project at the corner of Valencia and 14th streets, which includes 36 homes and three stores. It’s the first big project under the new Market Octavia Plan, and the Planning Commission decided to waive the plan’s limitation on construction of parking spaces to one space for every two units.
Parking, and its connection to the city’s Transit First policy, has long been a bone of contention between progressives and the driver-friendly Newsom Administration. But opponents of this project variance rightfully say that decreasing automobile dependency – and all its associated harm, from global warming to traffic congestion – requires the political will to stick to progressive policies developed over many years.
Today’s vote will test the board’s resolve.

MTA tries to help cyclists by removing bike lanes

San Francisco’s bicycle community is baffled by last night’s unanimous Metropolitan Transportation Agency vote to seek the removal of bike lanes at the intersection of Market and Octavia, where more than a dozen cyclists have been injured by cars making illegal right turns onto the freeway.
The logic offered by MTA traffic engineer Jack Fleck and the City Attorney’s Office (which is apparently concerned about liability issues after a couple injured cyclists sued the city) is that forcing bikes and cars to merge into one lane will prevent drivers from inadvertently turning into cyclists.
But that logic apparently only makes sense to bureaucrats and lawyers (and Mayor Gavin Newsom’s MTA appointees, none of whom seem to understand bike issues) because the plan has been uniformly criticized today by cyclists and other alternative transportation types. They say the forced merge at that busy intersection will only create more conflicts between bikes and cars.
“It makes no sense. I was really surprised they even brought it to the board,” said Leah Shahum, executive director of the San Francisco Bicycle Coalition, which was not consulted on the proposal.
Even the Planning Department agrees this is a dumb idea, one that conflicts with the Upper Market Design Plan that was approved less than two months ago. It calls for raised, colored bike lanes to make cyclists more visible and with trees and other visual barriers to make that illegal turn less attractive to drivers.
Ironically, bicyclists are placing their hopes for killing the proposal in Judge Peter Busch, who issued the current injunction against new bicycle projects and who will be asked Jan. 22 to approve this proposal. As Shahum said, “Our hope is that the judge denies it.”

Reinventing journalism

Journalism, the critics say, is dying. The model of news reporting that has dominated the United States for most of the past century — big, well-funded outfits paying reporters and editors to choose and produce what the public reads or views — is crumbling. The main culprits are media consolidation and corporate cutbacks, but the downward spiral is also being fed by declining readership, competition from the Internet, investor expectations, demographic shifts, self-inflicted wounds, and myriad other factors.

This years-long trend is hardly even news anymore, but there were some troubling developments in 2008. Some of the problems facing newspapers and broadcast outlets are the result of a bad economy, but everyone agrees the issues run deeper.

At the same time, however, countervailing forces are gathering momentum, many of them based in California and some in the Bay Area. People who believe in the indispensable role that reporters and editors play in this society are developing news models, ideas for reinventing journalism that could blossom in 2009.

From the Huffington Post and its 8 million monthly visitors to journalism experiments such as Spot.us and the San Francisco Public Press being hatched right here in San Francisco, the media landscape is shifting. As traditional newspapers contract and wrestle with relevance in the online age, Internet-based news organizations are filling the void and seeking to change the rules along the way.

Nowhere was this new reality more on display than last summer at the Democratic National Convention in Denver, where Bay Area new media powerhouses that included MoveOn.org, the Daily Kos, and Digg.com created the Big Tent, which played host to everyone from small-time bloggers to the most powerful politicians and big time political thinkers.

Among them was Arianna Huffington, the HuffPo founder who has become a leading voice for media reform and reinvention. The vision for journalism she espoused from the stage is a familiar one to Guardian readers but apostasy to believers in journalistic objectivity: writing from a progressive perspective to hold the powerful accountable to the public.

“Our highest responsibility is to the truth,” Huffington told us in a recent interview. “The truth is not about splitting the difference between one side and the other. Sometimes one side is speaking the truth … The central mission of journalism is the search for the truth.”

But the HuffPo has come under some criticism for not paying its legions of bloggers and for occasionally lifting content from media outlets that do pay their people. Searching for truth may be the central mission of journalism, but news organizations still have to find ways to fairly compensate the people who do so. Citizen journalism and blogging may be wonderful additions to the landscape, but in the end, democracy require reporters. You can’t properly cover City Hall or monitor the White House unless it’s a full-time job. And that seems to be the big challenge in this era of overextended resources.

 

TOO MANY MERGERS

The mainstream media landscape is bleak. Nearly every major newspaper in the country laid off significant numbers of reporters in the past year. The Tribune Company, which owns the Chicago Tribune and Los Angeles Times, among other properties, filed for Chapter 11 bankruptcy protection in December, and it’s entirely possible that several other big media companies will follow the same path in 2009.

It’s not that these papers aren’t making money — the LA Times, for example, remains profitable. But in the past decade, waves of mergers and consolidations led the giant conglomerates that own many US newspapers to take on huge debt. And private investors are demanding returns that may have been possible in the boom years of a decade ago but are only possible today if costs are cut so deeply that the basic journalistic mission of the nation’s great newspapers is in danger.

The alternative press isn’t exempt. The past decade has seen a wave of increased consolidation in the weekly industry, and at least one chain is now in serious financial trouble. Creative Loafing, which has its flagship paper in the big and growing Atlanta market, filed for bankruptcy this year. The company borrowed millions to buy Chicago Reader and Washington City Paper. Although all three papers were making money, when advertising slowed down, debt payments overwhelmed revenue.

Westword, a paper owned by Village Voice Media, a heavily leveraged chain, reported Dec. 18 on rumors that its parent company was facing financial problems. The conclusion of media critic Michael Roberts: the chain is doing fine. (Full disclosure: The Guardian won a lawsuit against VVM this year; the $18 million verdict is on appeal.)

So the scene is wide open for new approaches.

Among the San Franciscans who have taken a lead role in creating a new model for print journalism is Michael Stoll, the former San Francisco Examiner city editor who for the last few years has been spearheading creation of Public Press (www.public-press.org), which aims to create a non-commercial daily newspaper supported by readers and foundation grants.

The project (which Steven T. Jones has been involved with supporting) has a working business plan, began offering limited content during the last election, and recently received a grant from the San Francisco Foundation. Stoll said the time has come for a new newspaper model.

“It seems like the existing commercial models of journalism were always problematic, but their faults only became apparent when the economy started to fail. And we’re now faced with an abandonment of the core principles that media companies said they would never stray from,” Stoll said, listing basic government and corporate accountability among those core principles.

“The daily, routine coverage of public policy is now performed very selectively, even as the optional, more entertaining coverage is beefed up. There comes a point when the public’s patience with those priorities wears very thin and it increasingly demands straight talk,” Stoll said.

 

SHOW ME THE MONEY

The problem is how to fund it. News Web sites like ProPublica.org and journalism collectives such as the Center for Investigative Reporting have relied on large foundation grants to fund investigative and other public interest journalism. That’s fine for some things — but foundations often have their own political agendas, and the influence of foundation agendas on grant recipients can be pernicious (see “Pulling strings,” 10/8/1997). Foundation funding isn’t reliable, and a news outlet that became critical of the pet causes of a major funder could quickly find its income cut off.

Another model is being developed by Spot.Us (with the help of a two-year, $340,000 grant from the Knight Foundation).

Spot.us founder David Cohn wrote for Wired and the Columbia Journalism Review before going on to work as both a freelance journalist and technical consultant to news organizations. That unique combination, during a time of industry decline, got him thinking about how to fund good, public interest journalism.

Cohn developed the idea of creating a Web site where writers could pitch news stories and solicit funding for them directly from the public, a concept that drew from bloggers such as Christopher Allbritton and his Back-to-Iraq blog, as well as innovative charity sites such as DonorsChoose.org.

Stories published by Spot.us are then licensed under the Creative Commons, allowing anyone to use them for free and spread the work. News organizations can also buy the rights to an article by repaying Spot.us, or they can get the site to help fund their freelancers by paying for half up front and letting donors cover the rest.

“Everyone can benefit: the news organizations, the writers, and the public. But the market needs to be rethought,” Cohn told us, noting that the success of his venture will be up to the users. “It depends on whether people will see journalism as a public good and want to fund good stories.”

Media outlets that aim to have a full-time news-gathering staff need to tap into more stable funding sources — or they have to start slow and hope their new ideas catch on.

“With the extremely limited funding we’re starting out with, we’re planning to start a hybrid freelancer/volunteer news operation, and that’s not terribly sustainable in the long run,” Stoll said. “But we hope to increase our financial wherewithal on pace with increasing our news operations.”

Although finding resources for his new model is a difficult task in the current fiscal climate, the need becomes stronger all the time. “When talk centers on how long the commercial press will be able to operate in our community, it’s never too soon to talk about long-range alternatives,” Stoll said.

Stoll left the Examiner in November 2002 after clashing with the owners, the Fang family, about how to cover the city. After that, Stoll joined the media watchdog group Grade the News and taught journalism at San Jose State University, where he still works.

“The readers probably guessed that public interest coverage was not the Examiner‘s top priority, and they voted with their quarters not to support the paper long enough to see it survive in that incarnation,” Stoll said, referring to how the Examiner was sold to Denver billionaire Philip Anschutz after the Fang’s court-ordered subsidy ended. “And I see the same thing happening with the Chronicle.”

 

WHO GETS PAID?

Still, there are some new journalism experiments that have shown they can be moneymakers, most notably HuffPo, which has translated its enormous popularity into a substantial revenue stream from its online ads, a dynamic it has parlayed into increasing venture capital funding to expand its operations.

But HuffPo is still struggling to find a business model that allows it to expand its original reporting and pay journalists a living wage, a problem highlighted recently by a controversy about HuffPo stealing content without permission.

In an interview with the Guardian, Huffington admitted that HuffPo did inadvertently steal content from newspapers including Chicago Reader, which highlighted the issue on its blog, triggering a lively online discussion.

“With regards to the Chicago Reader, that was completely our editor’s fault, and it completely violated our guidelines, so I sent a letter to them wholeheartedly apologizing,” she told us.

Huffington said it’s important to honestly admit mistakes and use integrity to win the public trust. “We want to be very transparent about what we’re doing,” she said.

As for the larger issue of not paying for content, she makes a distinction between journalism and blogging, citing the mantra, “Facts are sacred, opinion is free.”

That means HuffPo bloggers benefit from a large audience for their work and from a team of moderators who filter out the flames and personal attacks that constitute so much of the online commenting. But they don’t get paid.

“We pay our reporters, we pay our editors, we pay anyone who works to report the news. But we don’t pay anyone who blogs their opinions,” she said.

In this media transition period, original reporting is being done on blogs (such as the politics blog at sfbg.com), that line isn’t so clear. But it does single out the important role that professional, full-time journalists play in the media landscape.

She said HuffPo now has six editors and writers on the payroll in Washington, DC, on top of the 50 employees (which includes technical, administrative, and advertising staff) in New York. And the outfit is in the process of launching an investigative reporting fund and story funding service, with models similar to Spot.us and Propublica.org. As Huffington said, “We’re all basically trying to reinvent journalism.”

But HuffPo’s model of journalism isn’t really that radical. The notion that reporters are allowed to have opinions, that news outlets can take on causes, push issues and represent the public interest, has been a part of the nation’s media landscape since before the American Revolution. The technology that allows almost anyone to publish a blog, and allows the public to comment on and challenge what’s written, is only a modern version of a long tradition. Small printing presses and small publishers with influential pamphlets date back to before Thomas Paine helped spark the revolution with Common Sense. And before the news media got huge, reporters and editors were part of the communities they covered and heard from their readers every day.

In many ways, the media pioneers these days are looking at reestablishing the best roots of the American press. The only thing missing at this point is the business model that, in 2009, works well enough to pay for it.
