Sup. Chris Daly has a juicy item on his blog. He’s uncovered that Lennar has already spent $500,000 to try and qualify a mixed-use development at Candlestick Point and Hunters Point Shipyard for the June 2008 ballot. This Lennar financed project is being framed as the Bayview Jobs, Parks and Housing Initiative.

But just who has benefited from Lennar’s spending spree, so far?

The city’s campaign finance data base shows that the biggest beneficiaries have been business lawyers Paul, Hastings, Janofsky and Waller; political consultants Terris, Barnes and Walters; campaign law and lobbying firm Nielsen, Merkamer, Parrinello, Mueller and Naylor, Sam Singer’s public relations firm, Singer Associates, Ground Floor, the public affairs firm run by Jim Stearns and Alex Tourk, and David Binder’s polling research. Oh, and then there’s the $17,500 Lennar paid to Pacific Petition, a petition circulation subvendor, to gather signatures to qualify this puppy for the ballot.

Meanwhile, supporters of the Bayview Affordable Housing initiative, which seeks to ensure that 50 percent of all housing built at Candlestick Point and the shipyard be affordable, are likely going to have to rely on community volunteers to qualify their competing measure for the June 2008 ballot.

Q. Which initiative do you think is most likely to benefit the people who currently live in the Bayview?

p.s As Lennar argues that it can’t afford 50 percent affordable housing in the Bayview, it’s worth noting that in 2006, Lennar President and CEO Stuart Miller made $1 million in salary, but his bonus decreased (from $21.5 million in 2005, paid half in stock and half in cash) to $4. 7 million, paid entirely in cash. Poor baby.

SONIC REDUCER Who can bring together cast-off crocheted critters and KISS? Early ’70s Ann Arbor, Mich., art noise and the Whitney Biennial? Vampires toiling in cubicles and Sonic Youth’s 1992 album Dirty (DGC)? Mike Kelley, man, can.

Ouch — the allusions get bumpy after almost three hours of mind-altering video candy. The medium may be the favored art material of the moment, but it’s only one weapon at the disposal of the cofounder of Destroy All Monsters — the Stooges’ weirder kissing cousins — and the Dirty cover artist. Kelley’s work can be found in major museum collections around the world, and he’s collaborated on video pieces with artists like Paul McCarthy in the past, but Day Is Done, which screens Jan. 31 at the Yerba Buena Center for the Arts, is his first feature, revamped as a narrative-ish stream from the installation version shown in 2005 at Gagosian Gallery in New York City.

Religious icons, ’80s modern dancers, lousy Nazi rappers, bad comedians, and spacey witches and vampires dance, sing, and hold forth throughout the video musical’s 32 chapters, augmented by a Kelley-written soundtrack that encompasses gospel and techno, light pop and monkish drone. Say I’m lost in pop idolatry, but the most wonderfully bizarre moment in this lengthy bizarre wonder arrives during a painful singles mixer furnished with irksome chair-desks as the differences among the assembled women — two African Americans, a white lost Hee Haw extra, a rocker in full KISS makeup, and a gloomy witch — are highlighted by portraits of their respective all-American idols: Kobe Bryant, R. Kelly, Garth Brooks, Gene Simmons, and Brandon Lee, all painted with clunky, thrift store–style passion. After getting an, erm, tongue lashing from the KISS girl for nattering about the largeness of some big stuffed bananas, the hick chick is forced to defend her painting of Brooks staring at a bare breast (in reality painted by Kelley). "But it ain’t even my tit — it’s my momma’s," the backwoods boob protests as the KISS fan sneers with all of Detroit Rock City’s blood-spitting wrath. "Gosh, I hope Garth don’t go for my momma and not for me!"

The rejoinder "That bitch is nuts!" might be a punch line to a half-cocked sitcom, but it’s also the perfect response to the old biddy dressing down a would-be school pageant Madonna for her posture or the blood-drenched hawker of a putf8um MasterCard that supports the "educational complex" — or any other denizen of Kelley’s jet-black-humored, bleakly antic fun house.

Looking back at the video now, however, Kelley can still picture changes to Day Is Done — each chapter a live-action re-creation of an extracurricular activity photo culled from a high school yearbook. For instance, the many students and office workers dressed as depressed vampires and gleeful witches seem a bit too trendy today, even for a man with a taste for monsters. "If I thought about it more, I would have done something less … au courant, I guess," Kelley drawls over the phone from his Los Angeles home. Does he still glimpse kids in full goth regalia? A heavy sigh, then, "Yeah. Also, it’s kind of gone into the art world. A lot of gothy art is being made."

A self-described "maximalist" who has made noise for years as part of Destroy All Monsters — a forerunner of experimentalists here and abroad — and later on his own, the man once pegged as a major proponent of installation-oriented "clusterfuck aesthetics" is clearly driven to strike out in fresh directions all the time. Day Is Done, for example, emerged from his work with repressed memories and his Educational Complex sculpture, a model of every school the Detroit native ever attended, with, he says, "all the parts I couldn’t remember left blank." The original idea for the video — shot over a few weeks in 2005 at an LA park, Kelley’s studio, and his alma mater, California Institute of the Arts — was to "fill in the blanks with screen memory."

"Also because this show was in New York, I thought doing something with a Broadway overtone would be funny because that’s something cultured New Yorkers are embarrassed about!" Kelley says, laughing.

Kelley is obviously still eager to venture into unexamined office parks of discomfort, provoking his viewers by pushing them into the dead spaces that fill the back lots of corporate break rooms and school yards. The artist’s well-known stuffed-animal works similarly evolved from an unspoken exchange with his audience. "When I first starting using that stuff, I was only working with things that were handmade, and it didn’t matter to me what they were — I was more interested in the idea of love and labor," Kelley explains. "But people were really, really fixated on the dolls, and I realized there’s a great kind of empathy for them, and also I realized that much of that empathy had to do with this kind of rise and fixation on child abuse and that whole victim culture that was coming up in the ’80s."

Shortly after one of those discarded dolls popped up on the cover of Dirty, Kelley, bandmate Cary Loren, SY’s Thurston Moore, and critic Byron Coley put together the 1994 three-CD retrospective Destroy All Monsters: 1974–1976 for Moore’s Ecstatic Peace! label to document the original lineup’s work before the arrival of the Stooges’ Ron Asheton and the MC5’s Michael Davis in the band. The founding group re-formed, while Kelley has continued to work sound components into his artwork and make and release music on his Compound Annex imprint.

Has music video ever been part of Kelley’s Wagnerian compendium of interests? "I’ve never been asked!" he says. "I don’t think I would do one for myself — who would show it? It’ll just be another thing that sits in a box in storage, like all my records." Still, his freshly edited feature might work. "It generated a tremendous amount of music," the artist muses. "In a sense, Day Is Done is one giant music video." *

BARACK OBAMA


This is now essentially a two-person race for the Democratic nomination, and no matter how it comes down, it’s a historic moment: neither of the front-runners for the White House (and by any standard, the Democratic nominee starts off as the front-runner) is a white man. And frankly, the nation could do a lot worse than either President Hillary Clinton or President Barack Obama.

But on the issues, and because he’s a force for a new generation of political activism, our choice is Obama.

Obama’s life story is inspirational, and his speeches are the stuff of political legend. He can rouse a crowd and generate excitement like no presidential candidate has in many, many years. He has, almost single-handedly, caused thousands of young people to get involved for the first time in a major political campaign.

The cost of his soaring rhetoric is a disappointing lack of specific plans. It can be hard at times to tell exactly what Obama stands for, exactly how he plans to carry out his ambitious goals. His stump speeches are riddled with words like change and exhortations to a new approach to politics, but he doesn’t talk much, for example, about how to address the gap between the rich and the poor, or how to tackle urban crime and poverty, or whether Israel should stop building settlements in the occupied territories.

In fact, our biggest problem with Obama is that he talks as if all the nation needs to do is come together in some sort of grand coalition of Democrats and Republicans, of "blue states and red states." But some of us have no interest in making common cause with the religious right or Dick Cheney or Halliburton or Don Fisher. There are forces and interests in the United States that need to be opposed, defeated, consigned to the dustbin of history, and for all of Obama’s talk of unity, we worry that he lacks the interest in or ability to take on a tough, bloody fight against an entrenched political foe.

Still, when you look at his positions, he’s on the right track. He wants to raise the cap on earnings subject to Social Security payments (right now high earners don’t pay Social Security taxes on income over $97,000 a year). He wants to cut taxes for working-class families and pay for it by letting the George W. Bush tax cuts on the rich expire (that’s not enough, but it’s a start). He wants to double fuel-economy standards. His health care plan isn’t perfect, but it’s about the same as all the Democrats offer.

And he’s always been against the war.

It’s hard to overstate the importance of that. Obama spoke out against the invasion when even most Democrats were afraid to, so he has some credibility when he says he’s going to withdraw all troops within 16 months and establish no permanent US bases in Iraq.

Hillary Clinton has far more extensive experience than Obama (and people who say her years in the White House don’t count have no concept of the role she played in Bill Clinton’s administration). We are convinced that deep down she has liberal instincts. But that’s what’s so infuriating: since the day she won election to the US Senate, Clinton has been trianguutf8g, shaping her positions, especially on foreign policy, in an effort to put her close to the political center. At a time when she could have shown real courage — during the early votes on funding and authorizing the invasion of Iraq — she took the easy way out, siding with President Bush and refusing to be counted with the antiwar movement. She has refused to distance herself from such terrible Bill Clinton–era policies as welfare reform, the North American Free Trade Agreement, and don’t ask, don’t tell. We just can’t see her as the progressive choice.

We like John Edwards. We like his populist approach, his recognition that there are powerful interests running this country that won’t give up power without a fight, and his talk about poverty. In some ways (certainly in terms of campaign rhetoric) he’s the most progressive of the major candidates. It is, of course, a bit of a political act — he was, at best, a moderate Southern Democrat when he served in the Senate. But at least he’s raising issues nobody else is talking about, and we give him immense credit for that. And we’ve always liked Dennis Kucinich, who is the only person taking the right positions on almost all of the key issues.

But Edwards has slid pretty far out of the running at this point, and Kucinich is an afterthought. The choice Californians face is between Hillary Clinton and Barack Obama. And Obama, for all of his flaws, has fired up a real grassroots movement, has energized the electorate, and is offering the hope of a politics that looks forward, not back. On Feb. 5, vote for Barack Obama.

President, Republican

RON PAUL


We have a lot of disagreements with Ron Paul and his libertarian worldview. He opposes the taxes that we need to make civil society function and the government regulations that are essential to protecting the most powerless members of society. From its roots in the Magna Carta and Adam Smith’s economic theories to the Bill of Rights, it’s clear the United States was founded on a social compact that libertarians too often seem to deny. And Paul compounds these ills in the one area in which he departs from the libertarians: he doesn’t support federal abortion rights. He’s been associated with some statements that are racially insensitive (to say the least). He clearly shouldn’t be president.

But he won’t — Paul isn’t going to win the nomination. So it’s worthwhile endorsing him as a protest vote for two reasons. His presence on the ballot serves to show up some of the hypocrisies of the rest of the GOP field — and he is absolutely correct and insightful on one of the most important issues of the day: the war.

Paul is alone among the Republican candidates for president in sounding the alarm that our country is pursuing a dangerous, shortsighted, hypocritical, expensive, and ultimately doomed strategy of trying to dominate the world militarily. He opposed the invasion of Iraq and thinks the US should pull out immediately. It’s immensely valuable to have someone like that in the GOP debates, speaking to the conservative half of our country about why this policy violates the principles they claim to hold dear.

Paul is absolutely correct that if we stopped trying to police the world, ended the war on drugs, and quit negotiating trade deals that favor multinational corporations over American families and workers, we would be a far more free and prosperous nation.

President, Green

CYNTHIA MCKINNEY


We endorsed Ralph Nader for president in 2000, in large part as a protest vote against the neoconservative politics of the Bill Clinton administration (the North American Free Trade Agreement, the General Agreement on Tariffs and Trade, welfare "reform," etc.). And Nader’s Green Party campaign had a place (particularly in a state the Democrats were going to win anyway). We’ve never been among those who blame Nader for Al Gore’s loss — Gore earned plenty of blame himself. But four years later we, like a lot of Nader’s allies and supporters, urged him not to run — and he ignored those pleas. Now he may be seeking the Green Party nomination again. Nader hasn’t formally announced yet, but he’s talking about it — which means he still shows no interest in being accountable to anyone. It’s too bad he has to end his political life this way.

Fortunately, there are several other credible Green Party candidates. The best is Cynthia McKinney, the former Georgia congressional representative, who has switched from the Democratic to the Green Party and is seeking a spot on the top of the ticket. McKinney has her drawbacks, but we’ll endorse her.

The real question here is not who would make a better president (that’s not in the cards, of course) but who would do more to build the Green Party and promote the best course for a promising third party that still hasn’t developed much traction as a national force. We’ve been clear for years that the Greens should be working from the grass roots up: the party’s first priority should be electing school board members, community college board members, members of boards of supervisors and city councils. Over time, leaders like Mark Sanchez, Jane Kim, Matt Gonzalez, and Ross Mirkarimi can start competing for mayor’s offices and posts in the State Legislature and Congress. Running a presidential candidate only makes sense as part of a party-building operation. (That’s what Nader did in 2000, and for all the obvious reasons he’s incapable of doing it today.)

But the Greens insist on running candidates for president, so we might as well pick the best one.

McKinney has a lot to offer the Greens. She’s an experienced legislator who has won several tough elections and taken on a lot of tough issues. As an African American woman from the South, she can also broaden the party’s base. She was a solid progressive in Congress, where she was willing to speak out on issues that many of her colleagues ducked (she was, for example, one of the few members to push for an impeachment resolution).

McKinney has her downside — in recent years she’s been flirting with the loony side of the left, getting a bit close to some Sept. 11 conspiracy theories that hurt her credibility (although she’s also made some very good points about the attacks and the lack of a serious investigation into what happened). And some of her supporters have made alarmingly anti-Semitic statements (from which, to her credit, she has attempted to distance herself). But she has to come out now, strongly, to denounce those sorts of comments and show that she can build a real coalition.

With those (serious) reservations, we’ll give her the nod.

Proposition 91 (use of gas tax)

NO


Prop. 91 is essentially an effort to ensure that revenue from the state’s gas tax goes only to roads and highways. It’s a moot point anyway: Proposition 1A, which passed last year, did the same thing, and now even proponents of 91 are urging a No vote.

But we’re going to take this opportunity to reiterate our opposition to Prop. 1A, Prop. 91, and any other ridiculous effort to restrict the use of gasoline tax revenues.

It should be clear to everyone at this point that the widespread overuse of automobiles is having far bigger impacts on California than just wear and tear on the roads. Cars are the biggest single cause of global warming, and they kill and injure more Californians than guns do, causing enormous costs that are borne by all of us. Driving a car is expensive for society, and drivers ought to be paying some of those costs. That should mean extra gas taxes and a reinstatement of the vehicle license fee to previous levels (and extra surcharges for those who drive Hummers and other especially wasteful, dangerous vehicles). That money ought to go to the state General Fund so California doesn’t have to close state parks and slash spending on schools and social services, as Gov. Arnold Schwarzenegger is proposing.

Proposition 92 (community college funding)

YES


Prop. 92 is another example of how desperate California educators are and how utterly dysfunctional the state’s budget process has become.

The measure is complicated, but it amounts to a plan to guarantee community colleges more money — a total of about $300 million a year — and includes provisions to cut the cost of attending the two-year schools. Those are good things: community colleges serve a huge number of students — about 10 times as many as the University of California system — many of whom come from lower-income families who can’t afford even a small fee increase. And, of course, as the state budget has gotten tighter, community college fees have gone up in the past few years — and as a result, attendance has dropped.

Part of the way Prop. 92 cuts fees is by divorcing community college funding from K–12 funding — and that’s created some controversy among teachers. Current state law requires a set percentage of California spending (about 40 percent) to go to K–12 and community college education, but there’s no provision to give more money to the community colleges when enrollment at those institutions grows faster than K–12 enrollment.

Some teachers fear that Prop. 92 could lead to decreased funds for K–12, and that’s a real concern. In essence, this measure would add $300 million to the state budget, and it includes no specific funding source. This worries us. In theory, the legislature and the governor ought to agree that education funding matters and find the money by raising taxes; in practice, this could set up more competition for money between different (and entirely worthy) branches of the state’s public education system — not to mention other critical social services.

But many of the same concerns were voiced when Prop. 98 was on the ballot, and that measure probably saved public education in California. The progressives on the San Francisco Board of Education all support Prop. 92, and so do we. Vote yes.

Proposition 93 (term limits)

YES


This is pathetic, really. The term-limits law that voters passed in 1990 has been bad news, shifting more power to the governor and ensuring that the State Assembly and the State Senate will be filled with people who lack the experience and institutional history to fight the Sacramento lobbyists (who, of course, have no term limits). But the legislature isn’t a terribly popular institution, and the polls all show that it would be almost impossible to simply repeal term limits. So the legislature — led by State Assembly speaker Fabian Núñez, who really, really wants to keep his job — has proposed a modification instead.

Under the current law, a politician can serve six years — three terms — in the assembly and eight years — two terms — in the senate. Since most senators are former assembly members, that’s a total of 14 years any one person can serve in the legislature.

Prop. 93 would cut that to 12 years — but allow members to serve them in either house. So Núñez, who will be termed out this year, could serve six more years in the assembly (but would then be barred from running for the senate). Senators who never served in the assembly could stick around for three terms.

That’s fine. It’s a bit better than what we have now — it might bring more long-term focus to the legislature and eliminate some of the musical-chairs mess that’s brought us the Mark Leno versus Carole Migden bloodbath.

But it’s sad that the California State Legislature, once a model for the nation, has been so stymied by corruption that the voters don’t trust it and the best we can hope for is a modest improvement in a bad law. Vote yes.

Propositions 94, 95, 96, and 97 (Indian gambling compacts)

NO


We supported the original law that allowed Indian tribes to set up casinos, and we have no regrets: that was an issue of tribal sovereignty, and after all the United States has done to the tribes, it seemed unconscionable to deny one of the most impoverished populations in the state the right to make some money. Besides, we’re not opposed in principle to gambling.

But this is a shady deal, and voters should reject it.

Props. 94–97 would allow four tribes — all of which have become very, very wealthy through gambling — to dramatically expand the size of their casinos. The Pechanga, Morongo, Sycuan, and Agua Caliente tribes operate lucrative casinos in Southern California, spend a small fortune on lobbying, and convinced Gov. Arnold Schwarzenegger to give them permission to create some of the largest casinos in the nation. Opponents of this agreement have forced the issue onto the ballot.

The tribes say the deals will bring big money into the state coffers, and it’s true that more gambling equals more state revenue. But the effective tax rate on the slot machines (and this is all about slot machines, the cash engines of casinos) would be as little as 15 percent — chump change for a gambling operation. And none of the other tribes in the state, some of which are still desperate for money, would share in the bounty.

The big four tribes refuse to allow their workers to unionize. While we respect tribal sovereignty, the state still has the right to limit the size of casinos, and if the tribes want the right to make a lot more money, they ought to be willing to let their workers, not all of them Indians, share in some of the rewards. We’re talking billions of dollars a year in revenue here; paying a decent salary is hardly beyond the financial ability of these massive operations.

The governor cut this deal too fast and gave away too much. If the tribes want to expand their casinos, we’re open to allowing it — but the state, the workers, and the other tribes deserve a bigger share of the revenue. Vote no on 94-97.

Proposition A (neighborhood parks bond)

YES


This $185 million bond has the support of a broad coalition of local politicians and activists, Mayor Gavin Newsom, and every member of the Board of Supervisors. It would put a dent in the city’s serious backlog of deferred maintenance in the park system.

The measure would allocate $117.4 million for repairs and renovations of 12 neighborhood parks, selected according to their seismic and safety needs as well as their usage levels. It would also earmark $11.4 million to replace and repair freestanding restrooms, which, the Recreation and Park Department assures us, will be kept open seven days a week.

The bond also contains $33.5 million for projects on Port of San Francisco land, including a continuous walkway from Herons Head Park to Pier 43 and new open spaces at regular intervals along the eastern waterfront. While some argue that the Port should take care of its own property, it’s pretty broke — and there’s a growing recognition that the city’s waterfront is a treasure, that open space should be a key component of its future, and that it doesn’t really matter which city agency pays for it. In fact, this bond act would provide money to reclaim closed sections of the waterfront and create a Blue Greenway trail along seven miles of bay front.

One of the more questionable elements in this bond is the $8 million earmarked for construction and reconstruction of city playfields — which includes a partnership with a private foundation that wants to install artificial turf. There’s no question that the current fields are in bad repair and that users of artificial turf appreciate its all-weather durability. But some people worry about the environmental impact of the stuff, which is made from recycled tires, while others wonder if this bond will end up giving control of 7 percent of our parkland to the sons of Gap founder Don Fisher (their City Fields Foundation is the entity contributing matching funds for city-led turf conversions). Although the Rec and Park Department has identified 24 sites for such conversions, none can take place without the Board of Supervisors’ approval — and the supervisors and the Rec and Park Commission needs to make it clear that if neighbors don’t want the artificial turf, it won’t be forced on them.

Prop. A also earmarks $5 million for trail restoration and $5 million for an Opportunity Fund, from which all neighborhoods can leverage money for benches and toilets through in-kind contributions, sweat equity, and noncity funds.

And it includes $4 million for park forestry and $185,000 for audits.

With a 2007 independent analysis identifying $1.7 billion in maintenance requirements, this is little more than a start, and park advocates need to be looking for other, ongoing revenue sources. But we’ll happily endorse Prop. A.

Proposition B (deferred retirement for police officers)

YES


We’ve always taken the position that relying exclusively on police officers to improve public safety is as useless as simply throwing criminals behind bars — it’s only part of the solution and will never work as an answer all on its own.

But we’re also aware that the city is suffering a dramatic shortage of police officers; hundreds are expected to retire within a few short years, and those figures aren’t being met by an equal number of enrollees at the academy.

So we’re supporting Prop. B, even if it’s yet another mere stopgap measure the police union has dragged before voters, and even though the San Francisco Police Officers Association is often hostile to attempted law enforcement reforms and is never around when progressives need support for new revenue measures.

Prop. B would allow police officers who are at least 50 years of age and who have served for at least 25 years to continue working for three additional years with their regular pay and benefits while the pension checks they’d have otherwise received collect in a special account with an assured annual 4 percent interest rate.

The POA promises Prop. B will be cost neutral to taxpayers, and the city controller will review the program in three years to ensure that remains the case. Also at the end of three years, the Board of Supervisors, with a simple majority vote, could choose to end or extend it.

POA president Gary Delagnes added during an endorsement interview that department staffers in San Francisco who reach retirement age simply continue working in other police jurisdictions. If that’s the case, we might as well keep them here.

No other city employees are eligible for such a scheme, which strikes us as unfair. And frankly, one of the main reasons the city can’t hire police officers is the high cost of living in San Francisco — so if the POA is worried about recruitment, the group needs to support Sup. Chris Daly’s affordable-housing measure in November.

But we’ll endorse Prop. B.

Proposition C (Alcatraz Conversion Project)

NO


We understand why some people question why a decaying old prison continues to be a centerpiece of Bay Area tourism. A monument to a system that imprisoned people in cold, inhumane conditions doesn’t exactly mesh with San Francisco values.

But the Alcatraz Conversion Project, which proposes placing a half–golf ball–like Global Peace Center atop the Rock, is a wacky idea that looks and sounds like a yuppie tourist retreat and does little to address the island’s tortured past. People don’t have to support everything with peace in the title.

The proposal includes a white domed conference center for nonviolent conflict resolution, a statue of St. Francis, a labyrinth, a medicine wheel, and an array of what proponents call "architecturally advanced domed Artainment multimedia centers."

We agree with the ideal of dedicating the island to the Native Americans who fished and collected birds’ eggs from this once guano-covered rock for thousands of years and whose descendants carried out a bold occupation at the end of the 1960s. But this proposal seems based on wishful thinking, not fiscal or environmental realities.

The plan is backed by the Global Peace Foundation, which is a branch of the San Francisco Medical Research Foundation, a Mill Valley nonprofit founded by Marin resident and Light Party founder Da Vid. It’s just goofy. Vote no.

EDITORIAL It’s time for Democrats in Sacramento to show some political courage. Gov. Arnold Schwarzenegger has thrown down the gauntlet, offering a budget plan that isn’t just brutal and wrong — it’s a train wreck, a catastrophe that would devastate public education, parks, and basic services in California for years to come. The Democrats need to publicly declare this dead on arrival and offer an alternative plan that closes most of the $14 billion deficit with new taxes.

The budget deficit is serious business: it represents more than 10 percent of the state budget, and, after a series of tough years that have left California in debt, it’s not going to be easy to eliminate. And we recognize that Schwarzenegger is serious about across-the-board cuts — he’s willing to eliminate 6,000 jobs from the bloated prison system and let 22,000 inmates out early. That’s long overdue, and those savings can be incorporated in any final plan.

But slicing the education budget by $4 billion is insane. We’re not just talking about government employees losing their jobs or reducing bureaucratic overhead — this is about threatening the future of a generation of California kids. Those kinds of cuts — which absolutely will translate into a loss of teachers, school closures, and the end of music, art, and science programs — aren’t just one-year measures that can be repaired later. These are deep reductions in the state’s commitment to educating children who can’t afford private schools — and those kids will suffer for years.

Closing parks, cutting social programs, and eviscerating aid to cities — which will mean another round of cuts at the local level — would do serious damage to California. And none of it is necessary.

The governor’s pledge not to raise taxes demonstrates that, for all his talk of bipartisanship, at heart he’s a George W. Bush Republican. Cutting state spending at this level as the nation heads into a recession is insane; all the governor’s plan would do is drive the economy further into the tank, destroy more jobs, and reduce tax revenue, making next year’s problem even worse.

Think about it for a second: just restoring the vehicle license fee, which is a modest tax on car ownership, would bring in more than $4 billion, enough to save public education.

The richest Californians have done very well under the Bush tax cuts. And the deficits that those tax cuts created are part of California’s budget problem. Even increasing state income taxes slightly on those very-high-wage earners would bring in as much as $3 billion, according to the California Tax Reform Association — and since the rich can deduct state taxes from their federal payments, this would ultimately be a way to transfer money from Washington DC back to California.

That state’s sales tax code is still stuck in another era, and all sorts of things defined as services don’t get taxed at all — even though, according to the CTRA, "many ‘services’ are actually the temporary use of tangible commodities, such as admission to sporting events, ski resorts, golf courses, amusement parks, gyms and concerts, and should be in the tax base." Fixing that problem would bring in another $4 billion.

In other words, a few modest changes in the tax laws that would affect only the rich and those with excess disposable income would solve the budget deficit without cutting any services at all (except prisons, which need to be cut anyway). And that’s without even addressing the regressive mess that is Proposition 13.

A revenue-based solution would also prevent a deep hit to the economy, because shifting money from the very rich (who don’t tend to spend their marginal dollars) to the poor (who tend to put every new dollar right into the economy) is always a source of economic stimulus.

The Democratic leadership knows this. Most of the rank-and-file Democrats in the State Legislature know this. It’s not rocket science. But politicians in California are terrified of raising taxes — but in 2008 they have to get over it. It’s the responsibility of the Democratic leadership to educate the public about the real choices here, the real economics, the real stakes — and the only humane, credible solutions. If they cower in fear and cave in to the governor now, it’s hard to imagine when they will ever be able to take a stand.

Money for parks

GREEN CITY A broad coalition of politicians and activists is supporting Proposition A, the $185 million parks bond on the February ballot, with the rare unanimous support of the Board of Supervisors and Mayor Gavin Newsom.

But just how big an impact can this bond, which requires 66 percent voter approval, make? The city has spent the $110 million bond that voters approved in 2000 to repair parks and recreation centers, and an independent 2007 analysis identified $1.7 billion in backlogged park needs.

"This is one of an ongoing series of measures that we need to do every five or so years," board president Aaron Peskin told the Guardian.

The bond allocates $117.4 million for repairs and renovations of 12 neighborhood parks that were selected, Recreation and Park Department director Yomi Agunbiade told us, according to seismic and physical safety needs and usage levels.

The bond also earmarks $11.4 million to replace and repair freestanding restrooms. Noting that his department added 35 custodians in the last budget cycle, Agunbiade said, "So when we fix a bathroom, we’ll have staff to keep it open from 6 a.m. to 11 p.m. seven days a week."

Some aren’t keen on the bond’s inclusion of $33.5 million for Port of San Francisco land projects, including the Blue Greenway, a continuous walkway from Heron’s Head Park to Pier 43. San Francisco Community College trustee and Sierra Club member John Rizzo supports the measure but raised concerns about projects on Port land, particularly improvements at Fisherman’s Wharf.

But Peskin sees the Port lands inclusion as overdue: "For the first time there’s the recognition that the Port should not be treated as a stand-alone enterprise that has to do everything itself." As for the improvements around Pier 43, which is in his district, Peskin said, "Fisherman’s Wharf, like Union Square, is one of those geese that lay the golden egg" in terms of revenue from tourism.

The bond also earmarks $8 million for improvements to playing fields. Agunbiade said many fields are in terrible shape and in desperate need of work, "but this bond only affects about 7 percent of the city’s park land."

Some Potrero Hill neighbors are sounding environmental alarms about plans to install artificial turf at their local recreation center, but Agunbiade said there are also environmental benefits to turf, including decreased water and pesticide use.

Arthur Feinstein of the Sierra Club and San Francisco Tomorrow told us he strongly supports Prop. A, largely because it earmarks $5 million for trail restoration.

"The evidence is not in on the ill effects of artificial turf," Feinstein said, "but its ability to be in constant use frees up land for other uses, such as trail reconstruction, which makes a huge difference not just for native species and plants but people too, who need nature, especially in densely urban areas."

Isabel Wade, executive director of the Neighborhood Parks Council, says her nonprofit supports Prop. A, and she cited its inclusion of $5 million for an Opportunity Fund from which all neighborhoods can apply for matching funds for small park projects.

"A lot of little parks are not on the list because the capital costs of seismic repairs are so great, so how do you even get a bench or a toilet? Why not leverage money?" Wade said, observing that in-kind contributions, sweat equity, and noncity funds can be matched by the Opportunity Fund.

The bond includes $4 million for park forestry, along with $185,000 to do bond audits. This last item didn’t quell the objections of the San Francisco Taxpayers Union, a small group of conservative real estate interests that filed the sole opposition argument to Prop. A, courtesy of Barbara Meskunas, former legislative aide of suspended supervisor Ed Jew.

"Prop. A is a jobs program disguised as a parks bond," Meskunas wrote, also arguing the 2000 park bond money wasn’t properly spent. "The Parks Dept. needs new management, not new tax money."

But Peskin said this opposition from conservatives is unsurprising: "The Taxpayers Union opposes every tax and bond. They have never wanted to pay their fair share."

The questions the zoo won’t answer

Editors note: Craig McLaughlin sent the following questions to the office of the zoo’s hired flack, Sam Singer. We received no reply by press time.

I was raised around tigers. I know their habits and capabilities and was personally involved in constructing cages for them. I have been amazed by some of the comments attributed to Mr. Mollinedo in local news accounts. He initially reported that the wall of the moat was 20 ft high but the moat was 20 feet across. The difference between the elevations of the grotto and the viewing area is clearly, by any direct observation, only a few feet. That means that regardless of the depth of the dry moat, there is a question of whether the tiger could simply leap from bank to bank. Conventional wisdom in the tiger literature is that they can jump 20 feet, and there are accounts in the literature of leaps as long as 30 or even 33 feet. Given this, it makes no sense based on records available to Mr. Mollinedo that the grotto could be considered secure. In the end, we learned the moat’s width varied from 20 to 33 feet depending on how far one descended, but that the far wall was only 12.5 feet. Mr. Mollinedo then expressed surprise that a tiger could leap or climb over a wall of that height. Given my own knowledge of and direct observation of tigers, a tiger making that leap, even a captive tiger, is not surprising in the least, and taunting would not be a prerequisite. I would have to say that Mr. Mollinedo has no idea what he is talking about when it comes to tigers, and would even go so far as to say it was idiotic for him to make the comments he did–and I am prepared to say that in print. Does Mr. Mollinedo or your firm have any response?

1. Please provide a copy of the zoo’s written protocol concerning tiger escapes.

2. What is the size, caliber, and make of the zoo’s kill rifle(s)?

3. Where is it/are they stored?

4. How many people are authorized and trained to use it (them)? How often do they practice?

5. How many of those people were on the zoo grounds from 5-5:30 pm Christmas day?

6. Was a kill rifle (or rifles) and/or a shooting team deployed during Tatiana’s escape?

7. Minutes of the San Francisco Joint Zoo Committee talk about the improvements, including improvements to the lion house, providing keeper staging areas. Where is the nearest staging area to the to the tiger grotto and was it staffed at 5 pm on Christmas day?

8. When was the last date that the zoo conducted an emergency drill for an animal escape? AZA accreditation standards state “Emergency drills ensure that the instiutution’s staff know their duties and responsibilities and know how to handle mergencies properly when they occur…. Emergency drills shouldbe conducted at least once annually for each basic type of emergency.”

9. Please provide a copy of the record and evaluation of the last animal escape emergency drill? AZA standards state that “these drills need to be recorded and evaluated … Records of these drills need to be maintained.”

10. What training do security personnel recieve in how to respond to an animal emergency. How long is the training, who provides it, and are refreshers required? Had security personnel on duty that night been trained?

11. Why did cafe personnel not let the injured patrons inside so they would not be subject to further attacks? What are the policies about sheltering patrons in concession, entertainment and administrative areas during an animal attack?

12. Please provide a copy of the written protocol between the zoo and local police and other local emergency responders as required by AZA standards.

13. The Chronicle and other sources have reported that the tiger grotto was refurbished/remodeled recently and the cats returned in September. Is this true? Please describe what alterations or improvements were made? What contractor did the work? Was an architect involved in preparing plans and if so, who and at what firm? Was Tatiana housed in the same grotto prior to the remodel? Were keepers consulted in the rennovations?

14. There are at least two credible media accounts of tigers escaping from that grotto previously and one account of a near escape. These were known to keepers and in one case reported in a letter to zoo management. Was the zoo director aware of any of these accounts? Should he have been?

15. It is common practice in the business, public and nonprofit sector to consult with subordinates when conducting performance reviews of senior managers (a so-called 360 is one of the best known examples). When was the last performance review of Mr. Mollinedo conducted? Were keepers and other direct and indirect subordinates consulted as part of that review? Does the zoo have written policies in place concerning executive performance reviews? If so, please provide a copy.

16. I believe the zoo’s agreement with the city makes clear that zoo documents should be made available to the city Rec and Parks Department and therefore should be available to the public under the city’s sunshine law. The zoo, however, has not been forthcoming with specifics about the incident or readily provided related documentation. Why is this and how is this allowed under the contract?

17. Who was the designated person for emergency contact for the zoo at the time of the escape? When was that person accessed and by what form of communication?

18. Your firm specializes in crisis communication. The field of crisis communications is well established and has some commonly accepted principles. One of these is truthfulness–officials and spokespersons should be forthright and direct when communicating with employees, the public and the media. Another is timeliness–respond quickly to media and legal inquiries and be be proactive. Expressing empathy and putting people first are also important. Accepting responsibility goes a long way and blaming and attacking is contraindicated. As a public health official, I have been trained in crisis communication. Zoo management seems to be evasive and not forthcoming. Requests for interviews have not been responded to. How do you think the zoo performed initially in this regard and how have things changed since your firm became involved? For example, simple questions are still not being answered. I was surprised to know the zoo had been closed for a long time for a variety of reasons (including the fact that it was a crime scene) and then after they hired your firm, the Web site announces the zoo is closed in honor of the victims. This seem disingenuous to me. I find it dubious that that was really the motivating factor for the extended closure. Any response? (My own opinion is that given joint oversight, the wording of the agreement, and the fact that many dispositions will be conducted, I see no advantage to not responding affirmative and immediately to requests for information and records.)

19. Did the zoo have a media relations policy in place concerning employee interactions with the media prior to this incident. If so, please provide a copy.

20. Does the zoo have a response to SF Chronicle articles that paint a picture of poor management and very bad employee morale at the zoo?

The Zoo Blues

IN EARLY 1997, the San Francisco Zoo had a serious public-relations problem. The zoo wanted San Francisco voters to approve a $48 million bond measure to overhaul the facilities. But the Asian elephant exhibit was making the zoo look bad.

Tinkerbelle the elephant had been living alone since April 1995, when her longtime companion, Pennie, was put to sleep. Animal activists had been complaining that, for an animal that herds and has complex social interactions in the wild, life alone was cruel and unacceptable. According to the minutes from a board meeting of the San Francisco Zoological Society, the private group that manages the zoo, executive director David Anderson decided it was time to find a friend for Tinkerbelle. He thought he found her in Calle.

Calle was about 30 years old and on exhibit at the Los Angeles Zoo. She had put in her time entertaining humans, working shows in Las Vegas and giving rides to kids at the San Diego Zoo. Animal advocates in Los Angeles were trying to get her to a sanctuary in Tennessee. But Anderson decided he wanted her in San Francisco.
Animal rights advocates hated the idea. Gretchen Wyler, executive director of Endocino-<\h>based Arc Trust came to San Francisco to check out the zoo’s facilities. “I was devastated when I saw how small and barren it was,” Wyler told the Bay Guardian.

S.F. Zoo curator David Robinett denies that the decision to move Calle to San Francisco had anything to do with the timing of the bond campaign. “We were anxious to move ahead and get a companion for Tinkerbelle,” he told us.
Either way, the zoo was in a hurry — and it wound up with a huge problem on its hands. Before leaving Los Angeles, Calle was tested for tuberculosis. According to Susanne Barthell, who ran the Council for Excellence in Zoo Animal Management until her death last fall, the elephant population at the L.A. Zoo was known to have problems with T.B., a claim Robinett denies. But S.F. Zoo officials did not wait for the test results to come back before they brought Calle north on March 19, 1997.

The tests came back positive. The zoo had just bought a tuberculous elephant.

As soon as she arrived, Calle had to be quarantined from her new companion. And the financially troubled zoo got hit with elephantine medical bills. Calle’s treatment would run from $60,000 to $65,000 a year, curator Robinett told the city’s Commission of Animal Control and Welfare in July.

It got worse. In separating the elephants, zoo workers put Calle in the cushier exhibit quarters, which at least had some vegetation and a watering hole. Tinkerbelle was moved to neighboring quarters, without vegetation or water. She had to poke her trunk through a hole in the wall to refresh herself. (Only this month was the electrified barrier between the two areas removed permanently. Calle is cured, and the two elephants can now interact.)

The elephant debacle is all too typical. San Francisco’s zoo has never been one of the country’s best — but six years after it was placed in private hands, it’s in worse shape than ever. Privatization was supposed to save the zoo; instead it has failed it. A Bay Guardian investigation based on interviews and documents shows:

* Dozens of animals live in squalid, substandard conditions: primates have died because of disease-<\h>ridden cages, orangutans are cooped up in tiny cement boxes, rare rainforest mammals are losing hair.

* The number of zoo employees charged with taking care of the animals has plummeted — while the number of other employees has doubled.

* The U.S. Department of Agriculture is so frustrated with the S.F. Zoo’s animal mistreatment, it is threatening to fine the zoo thousands of dollars — and one foundation that had given hundreds of thousands to the zoo has withdrawn its funding.

* Thanks to a string of expensive bond issues, the public is still paying for the zoo, but zoo executive director David Anderson has seen his own salary substantially boosted.

* Marketing expenses have skyrocketed, and the zoo is heavily dependent on amusement park–<\d>type rides and other non-educational attractions to break even.

* City officials have become so skeptical of the zoo society’s ability to manage itself that Board of Supervisors president Tom Ammiano called for an audit last spring. Stanton W. Jones, an auditor who works for budget analyst Harvey Rose, is expected to release the audit late this summer.

In fact, the zoo is a case study of everything that is wrong with privatization.

A bad place to live


The push to privatize the zoo got rolling in 1990, when David Anderson was brought in from New Orleans’s Audubon Park and Zoological Garden. The zoo’s infrastructure was crumbling, and its finances were in bad shape. Sources in the Recreation and Park Department say Anderson enthusiastically advocated privatization as a solution.
Without accepting bids from other organizations, Rec and Park handed over control of the zoo to the private San Francisco Zoological Society, which had been raising money for the zoo since 1954. In the summer of 1993 the society agreed to lease the premises and take over management of the zoo, promising to balance its budget by June 30, 1998 (see “Sold!,” 10/19/94).

Anderson has made out handsomely from the deal. In 1994 the society paid him $81,443; by 1997 his total compensation had gone up to $148,500, including a $25,000 bonus — in a year when the zoo was still losing money.

The animals have fared much worse.

Within the past two months the U.S. Department of Agriculture, which governs animal care in zoos, has issued the society a warning. According to the USDA, inspectors have repeatedly notified zoo administrators about problems. If those problems aren’t corrected, the agency is now threatening to fine the zoo.

“We made it clear that they are not doing a good job on maintenance,” Wensley Koch, supervisory animal care specialist with the USDA’s western sector office, told the Bay Guardian. “Basically there’s a management problem.”
Records of inspection reports dating back to 1990 reveal problems throughout the zoo facilities — from the big cats’ lairs to the monkeys’ quarters. Wood is rotting; fences are rusting. Rats get into food areas and leave droppings.
Many of the problems are associated with the primate center, which has been a trouble spot since it was built in 1985. The colobus monkeys’ metal climbing bars were grooved. Since keepers couldn’t clean them of feces, the monkeys got sick from contact with their own excrement. The colobus population was decimated. According to Sandra Keller of Citizens for a Better Zoo, which was watch<\h>dogging the zoo at the time, 53 of the 85 primates in the center died.

“Once they opened it, the animals started dying,” Keller told the Bay Guardian. “They didn’t quarantine the new animals sufficiently when they were brought in. They basically wiped out the whole primate collection. It was heartbreaking.”

But turning the zoo over to the private society didn’t help. If anything, conditions are worse. A September 1996 USDA inspection found feces all over outdoor structures in the primate center. And in April 1997 an inspector noted that rat feces were found in the gorillas’ indoor housing area and that weeds and bushes grew out of control in the outside exhibit.

Inspectors frequently found that problems they had repeatedly brought to the society’s attention had not been addressed. For example, rotting wooden structures in the primate center went unrepaired for years between inspections; wire mesh fences keeping the colobus monkeys from escaping the exhibit continued to rust for a year after the USDA-imposed deadline to fix them.

Indeed, records from the past three years show that the zoo was regularly blowing its USDA-imposed deadlines on fixing facilities.

“When you’ve been writing ‘rust up’ for 10 years, most people get the message,” Koch told the Bay Guardian. “We’re at the point where, if the zoo doesn’t shape up, we might be forced to take an action against them. We can fine them up to $2,500 per violation.”

“If we’re looking at a monkey enclosure and we explain that a rusty enclosure is a problem and we note they also have rust at the zebra site, then the next time we come out, we don’t want to see a rusty elephant enclosure,” she said. “What becomes obvious is that either they don’t care about complying or they have decided not to. When they’re doing that, they’re using us as a quality control agency. The impression is that they have no quality control themselves.”

A 1993 incident involving an orangutan named Chewbacca sheds light on how zoo officials have tended to respond to agency involvement. Responding to an anonymous complaint, the USDA found that zoo officials had been planning to keep the 150-pound Chewbacca confined to a four-by-six-foot converted entryway for more than a year while they used his quarters to breed chimpanzees.

“From my perspective it appears that the project with the chimpanzees has been ill conceived,” William DeHaven, a sector supervisor with the USDA, noted on Oct. 12 of that year. “If you do not have sufficient space to conduct a breeding program properly, we feel it should not be conducted at all.”

USDA veterinary medical officer Richard Spira found Robinett to be uncooperative in dealing with the situation. “Incredibly, David Robinett took exception to my observation that the temporary night quarters were cramped at best,” Spira wrote to Koch. “This … is to give you a little taste of the double<\h>speak I’m getting at the zoo.”

The zoo has been no quicker to respond to problems brought to its attention by private citizens. On January 23, 1997, Barthell complained to both the zoo and the USDA. Barthell, an outspoken critic of the zoo, reported that she had seen a herd of six blackbuck standing in a driving rainstorm with no shelter, not even a tree. She also noted that 12 kangaroo were soaked and huddling against a wall for protection, their shelters too small to protect them.
Robinett responded to her concerns in writing. “This is not atypical of antelope,” he wrote. “In fact, many species react to inclement weather by seeking open space rather than cover.” He also said the kangaroo shelters were fine.

The USDA didn’t see it that way. The agency informed the zoo in February 1997 that shelter provided for both the blackbuck and the kangaroos was inadequate.

Robinett denied that the zoo has a cavalier attitude toward facilities problems.

“A lot of it is the age of the enclosures,” Robinett told us. “It is also a problem of limited resources. When you’re patching the patch of a patch — that’s when there are problems.”

He said that the zoo had to choose carefully how to spend its funds and that it gave the highest priority to the ones that officials there felt posed the greatest hazard to animals. And Wayne Reading, the society’s chief financial officer, says the infrastructure improvements are well underway, funded by donations and bond revenues.

Private zoo, public funds

When the society assumed control of the zoo in 1993, it was on the verge of collapse. City officials had neglected at least $10 million in facility maintenance; the number of paying visitors was in decline.

According to the zoo society’s lease, the city agreed to keep paying the zoo $4 million a year (to help cover the cost of civil service employees). In exchange, the society was supposed to take over the zoo and make it financially viable.

The society was not able to pull the zoo out of the red. In the spring of 1997, after four years of losing money, zoo officials admitted to acting parks director Joel Robinson that they were paying operating expenses with a loan of roughly $2.5 million from Wells Fargo as well as with money raised before the zoo went private. And in November of that year, Reading told the Rec and Park Commission that the marketing expenses for that fiscal quarter were over budget by $47,000. The society raised admissions prices in spring 1998 to cover an immediate $250,000 shortfall.

The society had already started going after an infusion of public funds. The minutes of society meetings show that for more than a year, the group devoted almost all its energy to getting a $48 million bond issue passed. According to the lease, the city agreed to sell at least $25 million in bonds to improve crumbling facilities. The society was supposed to raise $25 million from private funders by the time the bonds were sold. (To date, the society has raised $17 million.)

In June 1997, voters passed the $48 million bond issue. The zoo expected the bonds to start selling in late fall 1998, but they were delayed by a lawsuit seeking to overturn voter approval of the 49ers stadium bonds, which passed in the same election. That litigation was thrown out of court; the zoo bonds are expected to be sold this summer. The society has also taken $26 million from bonds issued for rebuilding after the Loma Prieta earthquake.

The city’s Recreation and Park Department responded to the zoo’s financial troubles by looking the other way. Rather than conduct an audit of the zoo or monitor the operation more closely, the department announced that it would no longer scrutinize the zoo’s budgets at all (see “The Secret Zoo,” 11/26/97, and “Don’t Feed the Zoo Society,” 12/10/97).

Rec and Park’s former finance director Ernie Prindle, who had been checking the zoo’s budgets until 1997, told the Bay Guardian that Anderson seemed to want the zoo to have the advantages of being run by a private organization while still being covered by a public one. When the zoo admitted in the fall of 1997 it was further in debt than it should have been, Anderson asked why the department could not just take care of the deficit and make the numbers work as it had done in the days when it was part of the city system, Prindle said.

“We had to tell him it does not work that way anymore, now that the zoo is a private contractor,” Prindle said.

Carnival or classroom?

By the end of October 1998 the zoo was in the black for the first time since the society took it over. But with that success has come controversy. Instead of investing in the animals, the society has capitalized on theme rides, such as the merry-go-round, the Puffer Train, and the Tiger Express ride.

Amusement-park attractions and a pricey marketing campaign — costing the zoo almost $3 million from 1995 to 1998 — have brought more visitors to the zoo. That plus higher ticket prices means more money. And Anderson is certain that with this increased revenue, the zoo will ultimately be able to shed its carnival atmosphere and focus on its true mission: education to foster environmental activism among visitors.

But if environmental activism is Anderson’s goal, he has a strange way of showing it. For example, when the zoo brought in a lorikeet exhibit in April 1998, it allowed its sponsors to place a display — a shiny Ford sports utility vehicle — near the site.

“If you’re setting yourself out as an educator, then you’ve got to have a source of funds,” Anderson told the Bay Guardian.

Some of Anderson’s more straightforward forays into environmental education have had trouble. One of his pet conservation projects is the Madagascar Fauna Group, head<\h>quartered at the San Francisco Zoo. Among other things, the group supports the protection of Madasgascar’s Betampona National Reserve and hopes to re-introduce zoo-bred lemurs and other endangered primates, such as aye-ayes, to the island nation’s wilds.

Since 1994, when the society assumed control of the zoo, it has spent $785,222 on its Madagascar projects.
In August 1997 Anderson brought two aye-ayes from Duke University’s primate center to San Francisco. Merlin and Calaban are the only male-female aye-aye pair in any zoo in the United States. Zoo officials hope to breed them.
Anderson speaks proudly of the work the zoo has done to educate people in Madagascar about protecting aye-ayes. But he hasn’t done such a great job protecting the ones in his care.

In Madagascar, aye-ayes spend time more than 60 feet high in the rainforest canopy, where they pull bugs from trees with their long fingers. In San Francisco, they live in an eight-foot-tall glass case.

Male aye-aye Merlin has had an ongoing problem with hair loss on his hind legs. As a result the zoo’s vet put him on steroids periodically from 1997 to 1998. Zoo officials blame the hair loss on two factors: premature separation from his mother, which took place while Merlin was at Duke, and the stress of being introduced to a new female.
Anderson told the Bay Guardian the hair loss wasn’t a big deal; some activists feel differently.

“That’s a shame,” Shirley McGreal, director of the International Primate Protection League, located in South Carolina, told the Bay Guardian. “Those guys cover a good distance of territory in the wild.”

But the aye-ayes haven’t been a huge success with zoogoers either. Aye-ayes are nocturnal creatures and extremely timid; Merlin and his mate, Calaban, rarely leave the shelter of leafy branches. The best chance you’ll get to see an aye-aye at the zoo is in the gift shop, on a sweatshirt or a postcard.

Paying the price

Luckily for the society, hardly any of its donors know about how the zoo animals live; it’s hard to woo grants with rusty fences, feces-filled cages, and cramped cement cells. But one funder did find out.

In September 1994, the zoo announced the opening of its $2 million Feline Conservation Center. Keepers had already raised questions about the new facility; some thought it was unsafe for the keepers because the animals could reach through the fence to the service area with their paws and claws.

When zoo administrators brought in Denver Zoo curator John Wortman, he had the same concerns. In his final evaluation to the Zoo Society, written in October 1994, Wortman stated, “I hate to sound like a broken record, but the old safety issue rises again. The repairs should have been made prior to the felines moving unto the enclosures. Fortunately, enough of the lock system functioned and no person or creature was hurt during the shake-down period.”

The keeper at the time, Terry Moyles, was fired by the zoo March 1995. Barthell and other animal advocates suspected he was dismissed because he was outspoken about the inadequacy of the facility; Robinett denied the charge.

In a Jan. 30, 1995, letter to the charitable foundation that was funding the center, Wortman described the Feline Conservation Center as “a poor design and dangerous exhibit for both the animals and the zoo keepers.”
The center’s problems got its funders’ attention. In a Feb. 19, 1999, letter to city auditor Jones, executives from the Redmond, Wash.–based Leonard X. Bosack and Betty M. Kruger Charitable Foundation blasted the zoo.

After the foundation made initial grants of more than $200,000 for the center, the letter states, “the Foundation Board also pledged two payments of $162,000 to be made in 1994 and 1995 contingent on continued progress reports. The Foundation rescinded the pledge of $325,000 in 1995 after years of unsatisfactory response from the Zoo Executive Director and the Board of Directors.”

The letter goes on to lay out how the zoo hired a contracting firm with no experience in building wildlife care facilities, how it wasted funds, and how it ignored the recommendations of its consultant.

“As John Wortman noted, the `major problem was the inability of the S.F. staff to design a modern animal facility,’” the letter stated.

Robinett denies that the zoo staff is to blame. “To say this was a screwup in design — I think that is incorrect,” Robinett told the Bay Guardian. “We have had success [with the center], especially with breeding. It’s been a very good exhibit.”

It is that attitude that makes some people worry about making animals pay the costs of privatization.
Privatization “has not helped animal care,” Ron Lippert, a longtime animal health technician and former member of the city’s Commission on Animal Control and Welfare, told the Bay Guardian. “What privatization has done is allowed the society to do more things on their agenda — without the public scrutiny they had before. It seems like this is [Anderson and the society’s] kingdom and palace, and they want to see how much they can show it off.

“But the bottom line is that with the cold, windy, and wet climate at the zoo, it’s the wrong city. It’s the wrong location. Animals who aren’t used to handling ocean climate have to handle it day in and day out. Maybe we just shouldn’t have a zoo here. The zoo society was supposed to do all this great stuff. But as far as zoos go, this one still sucks.”

When retired entomologist Jerry Powell caught two tiny light brown apple moths in a blacklight trap in his Berkeley backyard last winter, he had no idea of the furor his find would unleash — especially in the communities that were subsequently sprayed with female moth pheromones, a process that could come to San Francisco this spring.

Native to Australia and now found widely in New Zealand and the United Kingdom, the LBAM (or Epiphyas postvittana, as it’s known in bug circles) is classified as a plant pest, but it had never before been reported on the United States mainland, though it was found in Hawaii in the late 1880s.

So its discovery, first in Powell’s trap in February and then throughout the Bay Area and the Central Coast in March 2007, drove the US Department of Agriculture to declare a statewide emergency and issue quarantine and extermination directives.

The USDA’s problem, as Powell explained, is that unlike many moths, which only lay eggs on oak trees or eat holes in sweaters, the LBAM can lay eggs on and eat many, many plants.

"From each batch a hundred tiny caterpillars hatch and feed on a wide variety of shrubs and trees, using silk to tie the leaves up into bundles," Powell told the Guardian.

According to the USDA’s Web site, this pest could infest up to 80 percent of the continental US and attack 2,000 types of plants, causing huge economic and environmental damage.

Officials with the California Department of Food and Agriculture estimate the LBAM could cause up to $640 million annually in crop damage and control costs in California alone.

So starting last summer the CDFA required nurseries to either destroy infested plants or treat them with chlorpyrifos, an organophosphate pesticide derived from World War II nerve gas.

The agency also made ground applications of Bacillus thuringiensis (a genetically engineered bacteria) and hand-applied female moth pheromones in other infested areas, including Napa, Vallejo, and Mare Island.

But the agency’s most controversial act was the spraying of entire communities, including Santa Cruz, with Checkmate, a synthetic female moth pheromone made by the Oregon company Suterra. Since male moths use the real pheromone to detect females, flooding an area with similar-smelling stuff is supposed to confuse them and prevent mating.

The controversy, according to four lawsuits filed in Monterey and Santa Cruz counties, in which 73 percent of the moths have been found, began when the CDFA acted with minimal notice, without fully disclosing Checkmate’s contents until after the spraying occurred, and without adequately demonstrating that the moths were enough of an emergency to exempt the spraying from the California Environmental Quality Act.

Not to mention the sentiment, expressed by numerous members of the sprayed-on communities, that they felt as if they had been airlifted into Vietnam. For three nights in a row crop dusters, flying at 500 to 800 feet, traversed the skies, coating homes and gardens, parks and playgrounds with scentless, invisible, and largely untested female moth pheromones while freaked-out citizens were advised to remain indoors to avoid unwanted exposure.

Numerous health complaints were recorded after the spraying, along with questions about the scientific efficacy of the plan and the worry that the CDFA had paved the way to do an end run around due process — and next time could use heavy-duty pesticides.

Gina Solomon, senior scientist with the Natural Resources Defense Council, told the Guardian the spray’s contents are everyday chemicals, often labeled natural or organic, that degrade pretty rapidly into nontoxic by-products.

"But we did have a concern about tricaprylyl methyl ammonium chloride, a mild respiratory irritant, which could be of concern in a high dose to sensitive asthmatics," Solomon said.

Solomon gave the CDFA credit "for not picking a pesticide off the shelf," adding, "But it’s funny to see them trying to do the right thing, then tripping up over the public process. People don’t like planes going overhead spraying stuff and feeling like this is happening without their consent. I feel that if [the CDFA] is going to be inflicting this stuff on us, they need to let people know exactly why."

And with some scientists claiming that pheromones aren’t powerful enough to attract every single moth, Solomon is concerned the CDFA could decide to spray more toxic stuff.

"They could technically spray an insecticide, but I guarantee they’ll face a major protest, and it wouldn’t make any sense," Solomon said. "For all its nastiness, the moth is not a human health threat. It’s a threat to agriculture, nurseries, and gardens. We’re not talking about malaria."

Retired entomologist Powell suspects the LBAM was well established in California when he found it, given that it was trapped in a dozen counties within the next month.

"They had probably been here a few years before they happened to bumble into my light trap," he said. "And whenever you have anything that feeds on all kinds of plants, it doesn’t become a general defoliator but gets scattered around and causes minor damage. The problem is for nurseries that were forced to shut down and fumigate, but it’s not likely to become a noticeable pest in the garden. It’s likely to attract parasites and predators of similar species in the area."

James Carey, a professor of entomology at the University of California at Davis, is not a specialist in the LBAM. But he does know about invasive biology, having worked on the Mediterranean fruit fly. And in Carey’s opinion, the moth can’t be eradicated. It’s already widespread, he said — and disruptive mating pheromones have never been able to eradicate anything.

"It’s not numbers that matters, but numbers of locations," Carey told the Guardian. "It’s like metastatic cancer, where it’s not a matter of a tumor but of tens of thousands of tumors. So any [pockets of moths] that are not 100 percent eradicated can repopulate entire areas."

He acknowledges the USDA’s valid pest-related concerns. "But their entomologists should be able to argue that eradication is feasible, or face the facts that without effective tools not only to eradicate but to detect the moth it’s not possible," he said. "Pheromones are weak tools; not all moths come or respond to them. Even in an orchard they don’t work that well."

Casey warned that the CDFA will try to say that if we can’t eradicate the moth with pheromones, we’ll have to spray more pesticides. "But what if you can’t eradicate it because it’s too far gone?" he asked.

As for the unlikely scenario in which fixed-winged aircraft fly sideways between high-rises and the Transamerica Pyramid as they spray clouds of pheromones across the Castro, Chinatown, and beyond, Carey observed, "These moths can live in little pockets, so San Francisco will become a reservoir for them."

The CDFA’s Steve Lyle told the Guardian that at this point the agency has completed treatment for 2007 and is evaluating what it will do in 2008 and where it will do it.

"It’s fair to say that the entire program is being assessed, but we have made no definitive decisions and made no announcements," Lyle said.

With the Office of Environmental Health Hazard Assessment reassessing whether Checkmate causes harm to people, plants, and pets, Lyle added, "The moth is of serious concern to the feds. Unfortunately, this invasive pest is established in an urban area."

USDA public affairs specialist Larry Hawkins was a little less vague. "Since LBAM has been found in San Francisco proper and in the East Bay, these areas are likely to be treated in 2008," he said. "But we’re considering whether to treat them through ground applications or aerial application."

Hawkins said any control action "will be preceded by informational meetings with the public, so any actions will be fully disclosed."

David Dillworth, executive director of the nonprofit Helping Our Peninsula Environment, which is suing the CDFA over the Monterey spraying, advised San Francisco to get proactive and lean on its elected leaders.

"San Francisco still has time to get Nancy Pelosi and Dianne Feinstein, whose backyards will be sprayed, to put pressure on USDA to stop the eradication, since at this point all they can really do is control the moth," Dillworth said.

Pelosi’s press secretary, Drew Hammill, told the Guardian that Pelosi is "checking with state and city officials regarding the spread of this species.

"While the Speaker understands the consequences this moth can have on our precious ecosystem," Hammill said, "she is also concerned about the prospect of spraying any substance into the air in our city and its possible effects on public health and organic farming in our state."

After years of letting the free market dictate San Francisco’s housing mix — as a result steadily losing ground on the city’s affordable housing goals — the Board of Supervisors appears primed to place an ambitious bond measure on the fall 2008 ballot to address the housing imbalance.

Winning the necessary support from two-thirds of voters won’t be easy, coming on a ballot with the majority of supervisorial seats up for grabs, the presidential election, and a likely bond measure for rebuilding General Hospital. But Sup. Chris Daly, author of the affordable-housing bond measure, believes it’s a good time to have progressives focus on this most important of problems facing the city.

Last summer affordable-housing funds became a political football in a budget showdown between Daly and Mayor Gavin Newsom, a fight Newsom won, leading to a budget that prioritizes clean streets and a beefed-up Police Department over affordable housing. Newsom’s reelection campaign, which was just gearing up at the time, successfully cast Daly as the villain after the occasionally hotheaded supervisor threatened to bolster housing funds by cutting Newsom’s "pet projects," as Daly called them, which included a community justice center, a Police Academy class, street trees, and the Small Business Assistance Center.

Daly clearly lost that duel when he was savaged by the media and removed from his chair on the Budget Committee by board president Aaron Peskin. But now Daly has bounced back on the issue and secured solid support for his measure, which progressives and affordable-housing activists are already gearing up to fight for next year.

"Just because Newsom had a significant political operation this year does not mean that the affordable-housing issue went away," Daly told the Guardian after securing support for the amendment from six of his colleagues and a broad coalition of housing activists.

The measure would set aside $2.7 billion in city funds for affordable housing over 15 years. It is cosponsored by Sups. Tom Ammiano, Jake McGoldrick, Ross Mirkarimi, Gerardo Sandoval, Sophie Maxwell, Bevan Dufty, and Peskin and backed by Coleman Advocates for Children and Youth (which has made affordable family housing its top priority), the San Francisco Organizing Project, and the Housing Justice Coalition.

The measure would give affordable housing the same baseline of funding that the city already allocates to the Recreation and Park Department fund and the Library Preservation Fund — and less than what it sets aside for the Children, Youth and Families fund, the police fund, and the fire station maintenance fund.

"If we don’t have affordable housing, who is going to use the parks and the libraries?" housing activist Calvin Welch asked.

The amendment would also require the Mayor’s Office of Housing to prepare an affordable-housing plan every three years, present an annual affordable-housing budget, and complete these steps before the rest of the mayor’s budget proposals are finalized.

"I hope these provisions will bring some much-needed transparency and clarity to the affordable-housing process so we can avoid the train wreck of last year," Welch said.

In a June 8 editorial still posted at Newsom’s www.actlocally.org reelection Web site, the San Francisco Chronicle appears to have bought the mayor’s spin that Daly’s request to prioritize housing was all just political theater.

"There was nothing wise or efficient about Supervisor Chris Daly’s bald political ploy to strip $37 million from Mayor Gavin Newsom’s budget priorities and shift most of it into affordable housing," the Chronicle claimed. "Now let’s be clear. We know that San Francisco does need housing. Newsom’s budget also acknowledges the shortage, pumping $217 million into housing programs."

But, according to Welch, "the lie was that Newsom allocated $217 million when he really only allocated $78 million and the board added a further $10 million to the pot…. Newsom was taking credit for more than he was actually allocating and using those other funds to imply that he’d already used a massive amount of the General Fund when he was, in fact, allocating less than the year before. So he was actually talking about a cut."

Newsom press secretary Nathan Ballard told the Guardian that the total affordable-housing budget for fiscal year 2007–08 was $226 million — and of that total budget, "just approximately $90 million is General Fund dollars.

"The balance of funding (the difference between $226 million and $90 million) is a whole variety of other funding sources," he added, listing inclusionary housing in-lieu fees, redevelopment funds, jobs housing linkage fees levied on private development, federal and state sources, and other funds, many of which accumulate over many years, further distorting the budget picture.

But Welch said the housing situation is grim. As he told us, "The truth is that 92 percent of the city’s population can’t afford housing."

Daly’s affordable-housing amendment awaits a Jan. 8 board vote, following a request by Maxwell to allow for affordable housing to be built on sites used under the San Francisco Housing Authority — the so-called Hope SF program — a request Daly supports.

"My issue with Hope SF is [with] any proposal to build a large number of market-rate units on public housing sites," Daly explained, referring to a central tenet of the Newsom-created program.

Meanwhile, a June 2008 ballot measure being pushed by Newsom, Sen. Dianne Feinstein, and a host of other prominent local power brokers threatens to drain what little money the city does have for affordable housing in order to subsidize a massive push by Lennar Corp. to build 8,000 to 10,000 new houses in Candlestick Point, Hunters Point, and the Bayview.

Other than committing to replace low-income Alice Griffith public housing units at a one-to-one ratio, the Bayview Jobs, Parks and Housing Measure does not specify what percentage of the Lennar-built homes will be considered affordable or sold below market rates. Publicly, backers of the measure are presenting the efforts as focused on building a new stadium for the San Francisco 49ers, even though the team has said it would rather move to Santa Clara. Yet the campaign is also keenly aware of the public support for more affordable housing, at least if its ground-level pitches are any indication.

A paid signature gatherer who was recently working the 24th Street BART station (and who also told a Guardian source he was getting the unusually high sum of $2.50 per signature) presented the proposal to passersby as "an affordable housing measure."

Presidio gets a Starbucks

GREEN CITY First came the troubling mandate that the Presidio needed to break even financially, a new model for a national park area. Then came the Starbucks. That’s right: the Guardian has learned that a Starbucks will open next month in the Presidio’s Letterman Digital Arts Center, replacing locally owned Perk Presidio.

The new Starbucks — and all it represents — has raised the ire of both park and city activists. Scott Silver, executive director of Wild Wilderness, based in Bend, Ore., is concerned that the Presidio’s self-funding requirement is a harbinger of things to come across federal land management agencies. He says other properties following the Presidio model include Fort Baker in Marin, Sandy Hook in New Jersey, Valles Caldera National Preserve in New Mexico (Forest Service land), and Fort Monroe in Virginia.

"It brings the entire standard of our national park system down from a high pedestal to a pretty base commercial reality," Silver said. "I just look at the Presidio as the first in what I fear will be a long chain of national parks that move away from the model of a publicly funded public good to a privately funded, largely commercial extension of our commercial world that’s really not in any way what we associate with national parks."

City activists point to Proposition G, which passed by a healthy 16 percent margin in 2006, requiring formula retail stores to get conditional use authorization from the Planning Commission before opening in neighborhood commercial districts. Richmond District residents demonstrated the power of this legislation in September by blocking a Starbucks slated for Fifth Avenue and Geary.

Dean Preston, a neighborhood activist and attorney launching a statewide organization called Tenants Together, said, "The law specifically applies to neighborhood commercial districts, but I think those same people who live in neighborhood commercial districts are using the Presidio, which is here in their backyard. I think that whether or not [Letterman Digital Arts] is subject to local law on the issue, they should be taking into account that city sentiment when deciding what kind of businesses to lease there."

Raul Saavedra, leasing director for Letterman Digital Arts, told us he didn’t know about Prop. G but that the company is aware that some people have opinions about Starbucks. That’s why the LDA originally selected Perk Presidio for the space. "We wanted someone like that to be successful," Saavedra said. "And they weren’t, unfortunately."

So the LDA decided to look for a new vendor, considering sole proprietors and local and national chains. Saavedra said the smaller operators he considered had credit issues and concerns about making the location successful. He said the key factors in selecting Starbucks were its strong credit, good service, and solid sustainability program.

Dana Polk, the Presidio Trust’s senior adviser for government and media relations, said that as master tenant, the LDA is free to sublet that space to any company it chooses. Nevertheless, Saavedra indicated that the LDA anticipated possible concerns with choosing Starbucks: "We went to the trust before we signed the deal with Starbucks, because we knew that there would probably be some opinions. And at that time there was no problem."

This will not be the first national park area to host a Starbucks. That dubious honor goes to the San Francisco Maritime National Historic Park, which since October 2004 has housed a Starbucks as a subtenant of Kimpton Resorts in its Hazlett Warehouse, according to Shelley Niedernhofer, chief of administration and business services for the park.

However, National Park Service concessions program specialist manager Jo Pendry confirms that these Starbucks are the first examples of formula retail throughout the 391-site national park system.

Kim Winston, Starbucks manager of civic and community affairs for the western region, claimed that revenues from the Starbucks help fund National Parks Service operations, but Niedernhofer said of the Maritime Park, "We don’t receive any revenue directly from Starbucks." The Presidio arrangement will be similar.

But Preston isn’t mollified. He said, "To have a Starbucks go into the Presidio with no real public review right after a Starbucks is nearly unanimously blocked [by a Board of Supervisors’ vote] in the Inner Richmond does seem like a real contrast. The fact that there’s absolutely no public process for putting a Starbucks in such a visible spot is really a problem." *

Iron and Wine is what happens when you’re making plans for Friday night

So the night, Nov. 30, was a disaster of sorts but not for the reasons you’d think – and before you gag yourself with the prospect of another music review-turned personal soapbox or group session, bear with me. I’d like to think there is a point to my mawkishness. There is a certain regimen that proceeds from a typical Friday evening in the Bay that includes: 1) Driving with abandon, windows down, sunroof retracted, a hurly-burly of pre-weekend tune-age, a ritualized exorcising of the week’s frustrations, fleeting Bay vistas obstructed by billboards to the right and a swathe of mountains to the left; 2) The trickle of evening that always seem to greet you at that asymptote of the Peninsula where the sepia tones of suburbia meets the neon city with its bleary-eyed halogens and dayglo pleasuredoms; 3) A fine meal, which is to say nothing in moderation and everything in excess; and 4) A moment of love, nostalgia, tomfoolery, or any of a number of sensuous terms that might describe the simple, inexplicable pleasures that only live music can afford us – jouissance, freude, orphic plaisir, or, at the very least, “like a monkey making love to a skunk – maybe didn’t get all he wanted, but got all he could stand…”

Of course, you see, it didn’t happen that way. Driving up the 101 in Friday rush-hour has its occasional pleasures and aesthetic appeals but not when dinner reservations in the Mission and a hop-skip-jump over the Bay Bridge are timed out perfectly to coincide with Sam Beam’s performance at the Paramount. Over an hour parked in the concrete desert is a numbing death-trip. Honk. Break. Lurch. Then there’s the inevitable parking morass that is downtown SF: where one parks in the Richmond to play on Harrison – and the confusing cell-phone tag-games that often delay dinner reservations and sometimes end friendships.

Reservations cancelled, eh?

What?! 7:30 already! I’m barely through the second scotch and soda and already it’s time to move on. Back onto the road and across the great steel artery leaving the flickering night of the city before it’s even begun in earnest. Wait…wait…where’s my WALLET?!

Believe it or not, we all might learn a thing or two from Iron and Wine’s Sam Beam – namely, not to sweat the little things and embrace your quotidian flaws. His Hirsuiteness took the cavernous auditorium of the Paramount on Nov. 30 for two hours of brittle ballads and po’ boy twee pop.

What’s more San Francisco than spending the holiday with former mayoral hopeful (and possible candidate for supervisor) Chicken John Rinaldi? Lust and loss

Many dedicated faggots have made the comparison between cocksucking and prayer, especially when knees are planted in the ground, eyes closed because of something too powerful to look at. But Christopher Russell’s Landscape, a book of black-and-white photos of men cruising San Francisco’s Buena Vista Park, at first appears to take this assertion one step further — with the trees towering above and light cascading onto shirts, hands, exposed asses, it’s almost as if these men have stumbled into heaven. If so, they appear unaware — in one early photo, someone crouches forlorn in the shadows between trees; above him beckon three perfectly crafted beams of light. There’s an eeriness to many of these photos, as the sumptuousness of the foliage and the brashness of the sunlight render the sex acts comparably mundane: white T-shirts pulled up and white briefs pulled down like on a porn set; the spooky silhouette of a face pressed against a waiting crotch; baseball caps and dark sunglasses holding distance.

It’s when the images become fractured that they reveal depth of feeling — faces merging with leaves and light, heads blending into trees awaiting sky, the motion of hands and arms and legs conjuring a certain type of flight. When the camera pulls back, it’s the sky that’s shimmering, a brightness between branches and leaves with just a tiny figure below. We see a face turned, or the back of a head — yet the action is not where the figure is gazing but above and around, leaves swaying in the breeze and branches shaking underneath the glow of the setting sun. It’s here that we can truly appreciate the complex landscape of lust and loss, adventure and longing.

In one photo, the silhouette of someone’s coat blends so neatly with that of a tree that it resembles a sagging branch, and it brings to mind an image reproduced in the French writer Tony Duvert’s Good Sex Illustrated, a scathing 1974 critique of a five-volume "liberal" sex manual published the previous year in France. The photo, taken from the handbook in question, shows a park somewhat more groomed and far less picturesque than Buena Vista, but we see light reflecting off trees and a man in an overcoat standing to the side of a path, his back to us. Unlike in Russell’s photos, however, it’s the man who seems monumental and the trees a backdrop as a child gazes up from several feet away, apparently immobilized by what he sees. The image, from the volume aimed at 10- to 13-year-olds, is meant to illustrate the dangers of pedophiles who apparently lurk in parks. But Duvert indicts the motives of parents who warn their children about such violence, declaring, "What they are really trying to do isn’t to protect the child but their own exclusive right to do whatever they want with him."

In Good Sex Illustrated, published in English for the first time this month, by Semiotext(e), Duvert skewers the emerging field of sex education as nothing but "science taking charge of the old moral order." With a savage glee, he dissects the volumes of the manual allegedly geared toward helping young adults discover their sexual selves but instead intent on "libidinal dismembering" and centered on a "pro-birth obsession." Duvert is most hilarious when he compares what the handbook calls a "feeling of total fulfillment" from pregnancy to that of a teenager getting fucked in the ass: "Jean scrubbed his ass pensively: is this what they call a feeling of total fulfillment?" In a related footnote he brilliantly comments, "It goes without saying that as soon as the pleasure of having a cock inside your body stops being depreciated, the honor of having a fetus there won’t be over-emphasized." But if this is one of Duvert’s most skillful reversals, it also illuminates a gap in his analysis. After all, he’s comparing a woman’s alleged feelings during pregnancy to a man’s response to getting fucked (we hear nothing about a woman’s sexual pleasure). While Duvert incorporates a nuanced gender critique into many of his readings, he prioritizes male sexuality throughout the book, which ends up thwarting him in his overall mission of subverting the social order by encouraging the sexual freedom of all children.

David Halperin’s What Do Gay Men Want? An Essay on Sex, Risk, and Subjectivity has a similar aim of moving conversations about sexuality (and sexual safety) away from standards of "healthy functioning" and "rational" or "irrational" behavior. Halperin seeks to champion queer cultural traditions over the judgments of psychology and the false dichotomy between risk and safety. (In a homophobic culture, what gay sexual behavior, after all, isn’t risky?) In searching for a more comprehensive approach to gay male sexual splendor, Halperin revisits a vulnerable and challenging 1995 essay by Michael Warner in the Village Voice, "Unsafe: Why Gay Men Are Having Risky Sex," in which Warner at one point states that "abjection continues to be our dirty secret." If Warner talks about abjection as a sense of "dirtiness" due to societal condemnation, Halperin describes it as "an experiment with the limits of both destruction and survival, social isolation and social solidarity, domination and transcendence." In other words, "the more people despise you, the less you owe them, and the freer and more powerful you are." Halperin proposes, "Instead of worrying about the appeal of abjection to gay men, … what we really should be doing is trying to think concretely about … how to make it work for us."

It’s a provocative idea, but unfortunately Halperin here departs from his methodical (and meticulously footnoted) analysis of safer sex strategies to endlessly circle around Warner’s essay and certain passages from the writing of Jean Genet, resulting in a repetitive rhetorical jumble. To be sure, Halperin provides a few illuminating examples (including the writing of porn star Scott O’Hara and the brilliant and short-lived zine Diseased Pariah News), but What Do Gay Men Want? could certainly have benefited from an analysis of the wealth of queer world-making in the era of AIDS that has centered on the possibilities (and perils) of an embrace of outsider status — the work of David Wojnarowicz, Samuel Delany, Derek Jarman, Gregg Bordowitz, Justin Chin, or Essex Hemphill, to name a few among innumerable possibilities. Or, perhaps, an analysis of Christopher Russell’s photos, where the messiness of desire becomes landscape.

Sen. Dianne Feinstein, former mayor Willie Brown, Sup. Sophie Maxwell, and Mayor Gavin Newsom in recent weeks have come out in support of a proposed ballot measure that would allow Lennar Corp. to develop thousands of new homes at Candlestick Point, create 350 acres of parks, and possibly build a new 49ers stadium at Hunters Point Shipyard.

The campaign for the Bayview Jobs, Parks and Housing Initiative just launched its signature drive, but the measure should qualify relatively easily for the June 2008 election, given new low signature thresholds and the campaign’s powerful backers.

The measure would give Lennar, which is also involved in Treasure Island and much of the Bayview–Hunters Point redevelopment area, even more control over San Francisco’s biggest chunks of developable land.

But should San Franciscans really reward Lennar with more land and responsibilities when the financially troubled Florida developer has a track record in San Francisco and elsewhere of failing to live up to its promises, exposing vulnerable citizens to asbestos dust, and using deceptive public relations campaigns to gloss over its misdeeds?

As the Guardian has been reporting since early this year (see "The Corporation That Ate San Francisco," 3/14/07), Lennar failed to monitor and control the dust from naturally occurring asbestos while grading a hilltop in preparation for building condominiums on Parcel A of the former Hunters Point Naval Shipyard.

Last month the Bay Area Air Quality Management District’s Board of Directors asked staff to pursue the maximum fines possible for Lennar’s violations, which could run into millions of dollars, particularly if they are found to be the result of willful or negligent behavior.

"It’s clear to everyone in the agency that this case needs to be handled well," BAAQMD spokesperson Karen Schkolnick told the Guardian. "It’s in everyone’s interest, certainly the community’s, to get resolution."

The air district gives parties to whom it issues a warning three years to settle the matter before it goes to court. Lennar officials have publicly blamed subcontractors for failing to control dust and leaving air-monitoring equipment with dead batteries for months on end, but the BAAQMD is treating Lennar as the responsible party.

"It’s air district policy to deal with the primary contractor, which in this case is Lennar, although additional parties may be held liable," Schkolnick said.

Accusations of willful negligence also lie at the heart of a Proposition 65 lawsuit that was filed against Lennar for alleged failures to warn the community of exposure to asbestos, a known carcinogen (see Green City, 8/29/07).

Filed by the Center for Self Improvement, the nonprofit that runs the Muhammad University of Islam, which is next to Parcel A, the suit alleges that the construction activities of Lennar and subcontractor Gordon N. Ball "caused thousands of Californians to be involuntarily and unwittingly exposed to asbestos on a daily basis without the defendants first providing the adjacent community and persons working at the site with the toxic health hazard warnings."

Now fresh evidence from another whistle-blower lawsuit filed by three Lennar employees (see "Dust Still Settling," 3/28/07) shows that higher-ups within Lennar reprimanded and reassigned a subordinate who told subcontractors to comply with mandated plans or face an immediate suspension of construction activities at the Parcel A site.

In an April 21, 2006, BlackBerry message that was copied to Lennar Urban senior vice president Paul Menaker and other top Lennar executives, Lennar Urban’s regional vice president Kofi Bonner wrote to Gary McIntyre, Lennar/BVHP’s Hunters Point Shipyard Project manager, "Gary why do you insist on sending threatening emails to the contractor. If you can no longer communicate directly without the threat of a shutdown … perhaps we should find another area of responsibility for you to oversee. Such emails should only be sent as documentation of [a] conversation."

McIntyre says he was just trying to do his job, which involved ensuring that subcontractors abided by the long list of special health and safety criteria that were developed for this particularly hazardous work site, located in an area long plagued by environmental injustice.

The shipyard is a Superfund site filled with toxic chemicals, and although the 63-acre Parcel A had been cleaned up enough to be certified for residential development, it sits atop a serpentine hill full of naturally occurring asbestos, a potent carcinogen. So the Department of Public Health and the BAAQMD both insisted on a strict plan for controlling dust, which Lennar used to sell the community on the project’s safety.

Yet when McIntyre began insisting in writing that Lennar and its subcontractors adhere carefully to those rules, he was removed from his job. In a work evaluation signed Oct. 17, 2006, Menaker described McIntyre as "a good company spokesperson as it relates to Hunters Point Shipyard" but claimed that he required major improvement in his leadership and communication skills.

"As a manager, he needs to focus on achieving his ultimate mission, rather than focusing on details. Poor communication skills have led to incomplete and often incorrect information being disseminated," Menaker wrote.

The ultimate mission for Lennar — which has seen its stock tank this year as it’s been roiled by a crisis in the housing market — was to get Parcel A built with a minimum of problems and delays. And as concerns about its behavior arose, its communication strategy seemed to be more concerned with positive spin and tapping testimony from financial partners than with putting out a complete and correct view of what was happening.

Whether or not McIntyre was a good Lennar employee, he was at least trying to do right by the community, as records obtained through the lawsuit’s discovery process show. As McIntyre wrote in a three-page response to Menaker’s evaluation, "Our BVHP Naval Shipyard project has unique environmental requirements and compliance therewith is mandatory."

But the record is clear that Lennar didn’t comply with its promises, raising serious questions about a company that wants to take over development of the rest of this toxic yet politically, socially, and economically important site.

BUYING ALLIES


So who is really behind the Bayview Jobs, Parks and Housing Initiative, which does not even have the support of the 49ers, who say they’d rather be in Santa Clara?

The measure was submitted by the African American Community Revitalization Consortium, which describes itself as "a group of area churches, organizations, residents and local merchants, working to improve Bayview Hunters Point." Yet this group is backed by Lennar and draws its members from among those with a personal financial stake in the company’s San Francisco projects.

AACRC founders Rev. Arelious Walker of the True Hope Church of God in Christ in Hunters Point and Rev. J. Edgar Boyd of the Bethel African Methodist Episcopal Church of San Francisco are both members of Tabernacle Affiliated Developers, one of four Bayview–Hunters Point community builders who entered into a joint venture with Lennar/BVHP to build 30 percent of Lennar’s for-sale units at Parcel A. TAD is building the affordable units while Lennar develops the market-rate homes.

Neither Walker nor Boyd disclosed this conflict of interest at a July 31 Board of Supervisors hearing where they and the busloads of people Lennar helped ferry to City Hall created the illusion that the community was more concerned about keeping work going on Parcel A than temporarily shutting down the site while the health concerns of people in the Bayview were addressed.

Referring to reports from the city’s Department of Public Health, which claimed that there is no evidence that asbestos dust generated by the grading poses a threat to human health, Walker and Boyd warned that even a temporary shutdown of Lennar’s Parcel A site would adversely affect an already economically disadvantaged community. There is no way to test for whether someone has inhaled asbestos that could pose long-term risks, and Lennar supporters have used that void to claim all is well.

But even if community benefits such as home-building contracts, better parks, and job training opportunities do trickle down to Bayview–Hunters Point residents, will those opportunities outweigh the risk of doing business with a company that has endangered public health, has created deep divisions within an already stressed community, and is struggling financially?

In a recent interview with the Guardian, Minister Christopher Muhammad, whose Nation of Islam–affiliated nonprofit filed the Prop. 65 suit "individually and on behalf of the general public," described Lennar as "a rogue company that can’t be trusted."

"I’m concerned about the health of the community, as well as the other schools that border the shipyard," Muhammad said. "Our contention is that Lennar purposefully turned the monitors off. If you read the air district’s asbestos-dust mitigation plan, it appears that there was a way to do this grading safely. And the community went along with it. The problem was that Lennar was looking at their bottom line and violated every agreement. They threw the precautionary principle to the wind, literally. And the city looked the other way."

And even if Rev. Walker truly believes the June 2008 Bayview ballot measure is "a chance for all of us to move forward together," does it make financial sense, against the backdrop of a nationwide mortgage meltdown, to give Lennar permission to build thousands of homes at Candlestick Point when this measure doesn’t even specify what percentage of the 8,000 to 10,000 proposed new units would be rented or sold at below-market rates?

Lennar/BVHP has already reneged on promises to build rental units at its Parcel A site, and on Aug. 31, Lennar Corp., which is headquartered in Miami Beach, Fla., reported a third-quarter net loss of $513.9 million, compared to third-quarter net earnings of $206.7 million in 2006. Its stock continues to tumble, hitting a 52-week low of $14.50 per share on Nov. 26, down from a 52-week high of $56.54.

On Nov. 2, Reuters reported that Standard and Poor’s had cut Lennar’s debt rating to a junk-bond level "BB-plus" because of Lennar’s "exposure to oversupplied housing markets in California and Florida." And on Nov. 16 the Orange County Register reported that Lennar is shelving a condominium-retail complex in Long Beach and keeping high-rise condos it built in Anaheim vacant until the housing market bounces back.

Redevelopment Agency executive director Fred Blackwell, who was hired Aug. 30, told us his agency’s deposition and development agreement with Lennar wouldn’t let the company indefinitely mothball its housing units: "The DDA gives Lennar and the vertical developers the option to lease the for-sale units for one year, prior to their sale."

While the agency has been criticized for failing to do anything about Lennar’s problems on Parcel A and letting the company out of its obligation to build rental units, Blackwell said it is able to hold Lennar accountable.

"I feel like the DDA gives us all the tools we need," Blackwell told us. "We have opportunities to ‘cure’ whatever the contractor’s default is, but we can’t just arbitrarily shut things down."

But many in the community aren’t convinced. With the grim housing picture and the 49ers saying they’d rather be in Santa Clara, the only certain outcome from passage of this ballot measure would seem to be a mandate for the city to turn over valuable public lands and devote millions of dollars in scarce affording-housing funds to subsidize the ambitions of a corporation with a dubious track record that is actively resisting public accountability.

True, Lennar has promised to rebuild the Alice B. Griffith public housing project without dislocating any residents, and the measure also allows for the creation of 350 acres of parks and open spaces, 700,000 square feet of retail stores, two million square feet of office space, and improved transit routes and shoreline trails.

But although the rest of the shipyard is contaminated with a long list of human-made toxins, would passage of the initiative mean an early transfer of the shipyard from the Navy to the city and Lennar? And with that shift, the requirement that we put even more faith in this corporation’s ability to safely manage the project?

In October, Newsom, who was running for reelection at the time, told the Guardian he was worried about Lennar’s ability to follow through on "prescriptive goals and honor their commitments."

"We have to hold them accountable," Newsom told us. "They need to do what they say they’re going to do. We need to hold them to these commitments."

But how exactly is the mayor holding Lennar accountable?

In March, when the Guardian asked Newsom’s office if he intended, in light of Lennar’s Parcel A failures, to push ahead with plans to make Lennar the master developer for the 49ers stadium and Candlestick Point, the Mayor’s Office of Communications replied by referring us to Sam Singer, who has been on Lennar’s PR payroll for years.

On Nov. 18 the Chronicle reported that Singer was on the campaign team for the Bayview ballot initiative, along with former 49ers executive Carmen Policy, Newsom’s campaign manager and chief political consultant Eric Jaye, Newsom’s former campaign manager Alex Tourk, political consultant Jim Stearns, and political advertising firm Terris, Barnes and Walters, which worked on the 1997 49ers stadium bond and the 1996 measure for the Giants’ ballpark, both approved by voters.

In recent months Lennar has asked the Guardian to send questions to its latest PR flack, Lance Ignon, rather than Singer. In reply to our latest round of queries, about lawsuits and air district violations, Ignon forwarded us the following statement: "The record is abundantly clear that at each and every stage of the redevelopment process, Lennar has been guided by a commitment to protecting the health and safety of the Bayview–Hunters Point community. Lennar has fully cooperated with all relevant regulatory agencies and public health professionals to determine whether grading operations at the Shipyard pose a health threat to local residents. After months of exhaustive analysis, numerous different health experts — including [the Agency for Toxic Substances and Disease Registry] — concluded that the naturally occurring asbestos did not present a serious long-term health risk. Lennar will continue to work with the San Francisco Department of Public Health and other regulatory agencies to ensure the health of the community remains safeguarded."

Actually, the ATSDR report wasn’t quite that conclusive. It took issue with the faulty dust monitoring equipment at Parcel A and noted that exposure-level thresholds for the project were derived from industrial standards for workers who wear protective gear and don’t have all-day exposure. "However, there are studies in the scientific literature in which long term lower level/non-occupational exposures (from take home exposures and other areas of the world where naturally occurring asbestos occur) caused a low but epidemiologically detectable excess risk of mesothelioma," the ATSDR-DPH report observes.

It’s not surprising to see Lennar gloss over issues of liability, but it’s curious that Newsom and other top officials are so eager to push a proposal that would give Lennar control of Candlestick Point and perhaps result in a 49ers stadium on a federal Superfund site — without first demanding a full and public investigation of how the developers could have so miserably failed to enforce mandatory plans at Parcel A.

This fall the Newsom administration was peeved when the San Francisco Board of Education, which includes Newsom’s education advisor Hydra Mendoza, and the Youth Commission unanimously called for a temporary shutdown of Lennar’s Parcel A site until community health issues are addressed.

These demands were largely symbolic, since major grading at the site is complete, but the Mayor’s Office shot back with a Nov. 2 memo including the request that city department heads and commissions follow the example of the Hunters Point Shipyard Citizens Advisory Committee and the Bayview Project Area Committee, which have said they won’t hear further testimony on the dust issue "unless and until credible scientific evidence is presented to contradict the conclusions of the DPH, CDPH, UCSF and others that the construction dust at the Shipyard had not created a long-term or serious health risk."

Such complex points and counterpoints have been like dust in the air, preventing the public from getting a clear picture of what’s important or what’s happened at the site. But a careful review of the public record shows that, at the very least, Lennar has failed to live up to its promises.

PAPER TRAIL


As records obtained through a whistle-blower lawsuit’s discovery process show, Lennar employee McIntyre was reprimanded for e-mailing a group of Lennar subcontractors including Gordon N. Ball, Luster National, and Ghirardelli Associates and demanding that their traffic-control plan implementation be in place before Gordon Ball/Yerba Buena Engineering Joint Venture "begin using (oversize construction equipment) scrapers or articuutf8g trucks on Crisp Road."

In court depositions, Menaker, who became McIntyre’s supervisor in April 2006, claimed he "never told McIntyre that he should not raise issues related to what he perceived to be deficiencies in Gordon Ball’s dust control measures.

"Rather, I repeatedly advised him that management by e-mail would not accomplish the goal of improving Gordon Ball’s performance and that he needed to communicate with Gordon Ball and others on the project in a more effective fashion. As a result of my observations of his job performance and the feedback from others … on Aug. 1, 2006, we brought in other professionals to assist with duties initially assigned to McIntyre."

But public records reveal that things continued to go awry at the site, long after the bulk of McIntyre’s construction field-management duties were transferred to David Wilkins, an employee of Lennar subcontractor Luster National.

According to a report filed by the city’s Department of Health, on July 7, 2006, the DPH’s Amy Brownell drove to the Lennar trailers and informed McIntye that Lennar was in violation of Article 31, the city’s construction-dust ordinance, after she observed numerous trucks generating "a significant amount of dust that was then carried by the wind across the property line." She even observed a water truck on the haul road doing the same thing as it watered the road.

On Aug. 9 — eight days after McIntyre was relieved of his field-construction management duties and seven days after Lennar declared it could not verify any of its air district–mandated asbestos-monitoring data — Brownell drove to the Lennar trailers and spoke with McIntyre’s successor, Wilkins, about dust problems generated by hillside grading, haul trucks, and an excavator loading soil into articulated trucks.

"Every time [the excavator] dumped the soil into the trucks, it created a small cloud of visible dust that crossed the project site boundary. There was no attempt to control the generation of dust," Brownell observed in her Aug. 9, 2006, inspection notes.

On Sept. 21, seven weeks after McIntyre’s transfer, Brownell issued Lennar an amended notice of violation when it came to her attention that construction-dust monitors hadn’t been in place for the first two months of heavy grading.

On Dec. 8, 2006, five months after McIntyre’s reassignment, Lennar got slapped with another violation after DPH industrial hygienist Peter Wilsey observed on Nov. 30, 2006, that "dust from the work, particularly from the trucks on the haul road, was crossing the property boundary."

And on Aug. 17, a year after McIntyre left, the DPH issued Lennar its most recent violation for not controlling dust properly. But this time the notice included a 48-hour work suspension period to establish a dust-control plan monitor to be supervised by DPH staff, with costs billed to Lennar.

"The issuance of notices of violations shows the regulatory system is working," Brownell told the Guardian. "Dust control on a gigantic project like this is a continuous, everyday process that every single contractor has to do properly. That’s Lennar’s issue and problem. At DPH, we feel we have enough tools to do inspections, which Lennar gets billed for. And if they violate our requirements again, we’ll shut them down again. Or fine them."

So far, the DPH has not chosen to fine Lennar for any of its Parcel A dust violations.

"We considered it for this last violation but decided that shutting them down for two days was penalty enough," Brownell says, adding that while she’d "never just rely on air monitors, a monitor helps when you’re having problems with dust control, because then you can say, ‘Here’s scientific proof.’<0x2009>"

And scientific proof, in the form of monitoring data during the long, hot, and dusty summer of 2006, would likely have triggered numerous costly work slowdowns and stoppages. According to a memo marked "confidential" that the Guardian unearthed in the air district’s files, Lennar stated, "It costs approximately $40,000 a day to stop grading and construction" and "Gordon Ball would have to idle about 26 employees at the site, and employees tend to look for other work when the work is not consistent."

After Rev. Muhammad began to raise a storm about dust violations next to his nonprofit Muhammad University of Islam, Lennar Urban senior vice president Menaker accused him of being a "shakedown artist" when he refused an offer to temporarily relocate the school.

But Muhammad told the Guardian he refused the offer "because I didn’t want the school to be bounced around like a political football. And because I was concerned about the rest of the community."

Muhammad said he’s trying to sound the alarm about Lennar before it takes over all of Hunters and Candlestick points. As he told us, "This city is selling its birthright to a rogue company."

TRIGGER TIME


So what does the BAAQMD intend to do about Lennar’s enforcement record past, present, and future?

At an Oct. 29 hearing on asbestos dust, the BAAQMD Board of Directors unanimously instructed staff to pursue the maximum fines possible for Lennar’s Parcel A violations.

Air district staff tried to reassure the public that the "action levels" the BAAQMD set at the shipyard are health protective and provide a significant margin of safety.

Health impacts from unmonitored exposures, BAAQMD staffer Kelly Wee said, "are well within the guidelines," claiming a "one in three million" chance of developing asbestos-related diseases.

BAAQMD board member Sup. Chris Daly, who as a member of the Board of Supervisors voted July 31 to urge a temporary shutdown of Lennar’s Parcel A site, praised the air district for "moving forward with very conservative action levels.

"But these levels are political calls that are not necessarily scientific or health based," Daly added. "The initial violation, the one that, according to Lennar, CH2M Hill is responsible for, we don’t know what those levels of asbestos were, and that’s when the most significant grading occurred.

"The World Health Organization and [Occupational Safety and Health Administration] scientists are very clear that any level of exposure to asbestos comes with an increased health risk, and if you are already exposed to multiple sources, this becomes more serious," he said, referring to the freeways, power plants, sewage treatments plants, and substandard housing that blight the community, along with the area’s relatively high rate of smoking.

The BAAQMD’s Wee told the organization’s board that Lennar did not conduct proper oversight of its contractors and did not properly document the flow of air through its monitors but did discover and report its lapses in August 2006.

"Lennar exceeded the air district’s work shutdown level on at least 23 days in the post–Aug. 1, 2006, period, which is when the developer was monitoring asbestos dust," Wee observed, noting that the air district has two additional notices of violation pending against Lennar for 2007: one for overfilling dump trucks, the other for failing to maintain enough gravel on truck-wheel wash pads.

BAAQMD spokesperson Schkolnick later confirmed to the Guardian that the air district issued Lennar a notice of violation on Oct. 26 for failing to control naturally occurring asbestos at Parcel A, where grading is finished, but Lennar subcontractor Ranger is digging up the earth again to lay pipes.

"It’s time for the board to make sure the air district is as aggressive as possible to protect residents and sensitive receptors," Daly said. "Asbestos is carcinogenic. The state and federal government knows it. That was why there was an asbestos-dust mitigation plan. The air district asked for air monitoring because of the site’s proximity to a school. The air monitors were sold not just to the city but to the public as the major safeguards to the community, especially sensitive receptors, but during the most gigantic grading period and perhaps the most gigantic exposures, we don’t know what the levels of asbestos were."

Fellow BAAQMD board member Sup. Jake McGoldrick, who was a key swing vote against urging a Lennar work stoppage at the Board of Supervisors meeting in July, is now joining Daly in demanding full enforcement of the law.

"The July 31 resolution had no way to force Lennar or the SFRA to do anything," McGoldrick told the Guardian, explaining why he’s now taking a stronger stance. "It seemed that we’d reached the conclusion that the community didn’t want to shut down the project, since it included 31 percent affordable housing, and that the work was essential in terns of revitalizing the area and that the evidence presented seemed to show that everything is now under control."

But because the coalition of Lennar supporters — who didn’t mention they are on Lennar’s payroll until after the July 31 resolution failed — is now pushing a ballot measure to vastly expand Lennar’s control in our city, McGoldrick is demanding answers and accountability.

"We want to look into whether Lennar screwed up deliberately, and if so, fine them to the hilt," McGoldrick said. "But let’s get the project on Parcel A going, because the grading has been completed and it will be beneficial to the community."

McGoldrick claimed that in July he and Daly knew they had an air district hearing coming.

"And we knew where the strongest action could be taken in terms of sticking it to Lennar and showing them we won’t just be looking over your shoulder, we’ll be standing on it," McGoldrick told us.

"A fine means we have warned you — and we’ve got a gun to your head. It means if you don’t act properly, we can pull the trigger," McGoldrick said, noting that at the time of the July 31 vote the Parcel A grading was essentially done and no one could present any solid evidence that the public health had been harmed.

"So now the question is: did you or did you not do this? [A maximum fine of] $75,000 a day for 383 days, even if it’s not a lot of money to Lennar — it’s a lot of embarrassment," McGoldrick said.

But if Lennar tries to delay settling with the air district to avoid fines until after the June 2008 election, will its perceived unwillingness to face consequences backfire at the ballot box — and soil Newsom’s reputation as a great environmentalist in the process?

As McGoldrick observed, "Some of us are having serious second thoughts about going forward with Lennar. Our feeling is, you should sit down and cooperate with the air district and settle this thing with them. And you know darn well that we are standing there, ready to pull the trigger."

He framed the issue this way: "We’re saying to the Mayor’s Office, you guys have a responsibility [to ensure Lennar is accountable] before you give them another 350 acres — on top of the 63 acres they already have — just to save the mayor’s butt, since he blew it with the Olympics and the 49ers."

SF’s skatepark crisis

After attending SF360 Film+Club’s recent screening of Freedom of Space — a film about the harsh realities of enjoying an illegal sport– and then meeting some friends in a Safeway parking lot for a midnight skate-jam on some shitty ramps, the only thing I can say is: Why the fuck hasn’t anyone built a decent skatepark in this city?

All the elements have been present for over a decade: thousands of people who would come to a park if there was one, business owners who are sick of calling the cops on skateboarders, cops who are sick of wasting their time, and a huge base of high-profile companies like High Speed Productions (Thrasher, Slap, Juztapoz), DLX Distribution (Spitfire, Thunder, Anti-hero, etc.), FTC and Huf that could easily ante up some funds for a project. And why doesn’t SF have something like The Burnside Project in Portland? Are SF skaters just too lazy, or is there some force working against them? Rather than go off on an un-researched rant about the SF skate community not doing its job, I thought I’d talk to someone who’s been in the trenches for a while.

To find out more about the reality of SF’s skate park struggle I spoke to Rick Dinardo, Co-Founder of the Bay Area Skate-park Coalition.

SFBG: So Rick, my main question is: Why doesn’t San Francisco, the birth place of modern day street skating, have a decent park?

Rick Dinardo: Oh my god, how much time do you have? Before I get into it, though, you should realize that San Francisco finally is getting a good centrally-located skatepark. It’s going to be in Portrero Hill, right by the regular park that’s been there for years. As for why it’s taken the city 30 years to get off its ass and build one, well, that has to do with red tape, real estate, government corruption, lack of interest, and a whole lot of other bullshit, mostly money related.

SFBG: Well okay, I understand it’s difficult to get licenses and land and all that, but why haven’t all the huge skateboard companies, especially the ones that capitalize on their SF roots, why haven’t they gotten together and just fucking done the thing? It seems like they have enough money to at least fund a DIY project if not something as amazing as Rob Dyrdek’s deal in Kettering, Ohio.

Dinardo: First of all, I think you’re overestimating how much money these companies are making. These parks cost millions and millions of dollars, and that’s in places like Scott’s Valley where there is still open space for building. Land prices in SF are out of this fucking world. Whatever those companies chose to donate would be a drop in the bucket in a situation like this.

Also… I don’t think the companies you mentioned are very community oriented. I mean, this is capitalism we’re talking about, and they’re trying to make money, not sustain a community. I don’t think they care as much about supporting skateboarding in SF as they do about making the sport popular across the globe.

Gavin Newsom is going to win a second term; we know that, he knows that, and whatever they may say on the campaign trail, all of the candidates running against him know that.

It’s a sad state of affairs: San Francisco has been, at best, wallowing helplessly in problems under Newsom, and in many cases things have gotten worse. The murder rate is soaring; young people, particularly African Americans, are getting shot down on the streets in alarming numbers. The mayor has opposed almost every credible effort to do something about it — he fought against putting cops on foot patrol in the most violent areas, he opposed the creation of a violence-prevention fund and blocked implementation of a community policing plan, and he’s allowed the thugs in the Police Officers Association to set policy for a police department that desperately lacks leadership. The public transportation system is in meltdown. The housing crisis is out of control; 90 percent of the people who work in San Francisco can’t afford to buy a house here, and many of them can’t afford to rent either. Meanwhile, the city is allowing developers and speculators to build thousands of new luxury condos, which are turning San Francisco into a bedroom community for Silicon Valley. Newsom only recently seems to have noticed that public housing is in shambles and that the commission he appoints to oversee it has been ignoring the problem.

The mayor is moving aggressively to privatize public services (including turning over the city’s broadband infrastructure to private companies), and he’s done little to promote public power. He’s cracking down on the homeless without offering adequate alternatives to long-term housing. Much of the time, he seems disconnected, out of touch with the city; he won’t show up and take questions from the Board of Supervisors and won’t even comply with the Sunshine Ordinance and release his daily calendar so the voters can see what he’s doing all day. He rarely appears in public, unless his handlers have complete control of the situation.

In fact, almost all of the significant policy discussions and initiatives that are happening in San Francisco today (including the universal health plan that Newsom likes to take credit for) have come from the Board of Supervisors.

There are good things to say about Newsom. We were among the huge number of San Franciscans who applauded when Newsom directed the city to start issuing marriage licenses to same-sex couples. He did more than make a political statement, more than allow hundreds of couples to get married; he put one of the leading civil rights issues of our time on the center stage of the political agenda. And he made all of us proud to be San Franciscans. We were happy to see him stand up against the big international hotel chains and support striking hotel workers. In some ways, he’s brought modern management to the city — the 311 system, which connects callers directly to the proper city services, actually works, and sometimes works well.

But San Francisco is one of the world’s great cities, and it’s in serious trouble, and the person in charge isn’t offering much in the way of leadership — and he certainly isn’t offering the sort of progressive agenda that this city ought to be showing the nation. Newsom doesn’t deserve another term.

And yet the progressives in the city, who have come so very far since the return of district elections in 2000, were unable to field an electable candidate. We could spend pages dissecting why that happened. Matt Gonzalez should have made a decision much earlier in the process. Ross Mirkarimi should have run. The entire movement needs to be better about developing and promoting candidates for citywide office. But right now the issue on the table is this: who should the progressives, the independents, the neighborhood activists, the tenants, the people who have been dispossessed during the Newsom years, who don’t like the prospect of this mayor waltzing into another term atop a landslide majority, vote for Nov. 6?

We aren’t in the habit of endorsing for a big-league elective office people who haven’t put in their time in the minors. And Newsom’s challengers are not exactly a varsity squad. But many of them are raising important issues that Newsom has ignored, and we commend them all for taking on the difficult task of mounting a campaign against a mayor who most observers say is unbeatable. Our endorsements are, to be honest, protest votes — but we hope they’ll send a message to Newsom that there are issues, communities, and ideas he can’t just ignore after his coronation. The smaller the mayor’s margin of victory and the more votes the candidates who are pushing the progressive agenda collect, the less of a mandate Newsom will take into a second term that could be a truly frightening time.

Quintin Mecke has the strongest progressive credentials and by far the best overall approach to issues facing the city. He’s never held elective office (and had never run before), but he’s been involved in local politics for a decade. A volunteer with Tom Ammiano’s campaigns for supervisor and mayor and with Gonzalez’s mayoral campaign, Mecke went on to serve on the civil grand jury and the task force on redistricting, where he helped stave off attempts to chop up progressive supervisorial districts. He helped organize the South of Market Anti-Displacement Committee and now runs the Safety Network Partnership, a nonprofit that works to fight crime and violence in the city’s neighborhoods. He’s on the committee that monitors the city’s homeless shelters.

Mecke told the Guardian that "it’s hard to find an innovative, non-PR-type initiative out of the Mayor’s Office." He supports community policing, a progressive gross-receipts tax that would exempt small businesses, and a moratorium on market-rate housing until the city can determine how it will build enough affordable units. He complains that there’s no standard of care in Newsom’s homeless shelters. He opposes the privatization of public programs and resources.

Mecke tends a bit to bureaucratspeak; he talked about "horizontal conversations" instead of taking some issues head-on. And we’re concerned that he didn’t seem serious or organized enough to raise the modest amount of money it would have taken to qualify for public financing and mount a more visible campaign. But he’s a solid candidate, and we’re happy to give him the nod.

Ahimsa Porter Sumchai is a remarkable success story, an African American woman who grew up in the housing projects and wound up graduating from UC San Francisco’s medical school. She’s running primarily on the issue of environmental justice for southeast San Francisco — and for years has been one of the loudest voices against the flawed Lennar Corp. redevelopment project at and the reuse plan for the contaminated Hunters Point Shipyard. Sumchai says the shipyard can never be cleaned up to a level that would be safe for housing, and she suggests that much of it should be used for parks and open space and possibly maritime and green-industry uses. She’s highly critical of the low levels of affordable housing in market-rate projects all over the city, arguing that the developers should be forced to provide as many as 25 percent of their units at below-market rates. Sumchai is a physician, and she talks like one; her scientific language and approach sometimes confuse people. She suggested that one of the main causes of the homicide rate in the city is mental illness. "You can medically address people who are violent," she told us, saying the first step is to properly diagnose and treat depression in men. "Just as we looked at AIDS as an epidemic," she said, "we should look at violence as an epidemic." Which is, at the very least, an interesting approach.

Sumchai has some innovative ideas, including a universal child-care program for the city, paid for with a "fat tax" on unhealthy food. She’s a strong supporter of public power and a longtime critic of Pacific Gas and Electric Co.

She can be abrasive and temperamental, but she’s talking about critical issues that almost everyone else is ignoring. She deserves support.

Chicken John Rinaldi is the political surprise of the season, an artist and showman who has managed a traveling circus, run a bar in the Mission, put on unusual performances of every kind — and somehow managed to be the only person running for mayor who could qualify for tens of thousands of dollars in public funding. On one level Rinaldi’s campaign is a joke — he told us repeatedly he has no idea what he’s doing, and that if by some wild chance he were elected, he would hire people like Mecke and Sumchai to run the city. He’s the Dada candidate, with his entire run something of a performance art piece.

But Rinaldi has a real constituency. He represents a dying breed in the city: the street artists, the writers, the poets, the unconventional thinkers with economically marginal lifestyles, who were once the heart and soul of San Francisco. It’s hard to pin him down on issues since he seems to disdain any policy talk, but in the end, the very fact that he’s running speaks to the pressure on artists and the lack of support the unconventional side of the art world gets in this increasingly expensive city.

Rinaldi is the protest candidate of all protest candidates, but he’s going to get a lot of votes from people who think San Francisco needs to stop driving some of its most valuable residents out of town — and if that leads to a more serious discussion about artist housing, affordable housing in general, arts funding, and the overall crackdown on fun under Newsom, then it’s worth giving Chicken John a place on the ticket.

There are several other candidates worthy of consideration. Josh Wolf, a video blogger, served 226 days in a federal prison rather than turn over to the authorities tape of a demonstration he was filming. It was a bold and courageous show of principle (anyone who’s ever done time knows that spending even a week, much less month after month, behind bars is no joke), and it speaks to his leadership and character. Wolf is talking about some key issues too: he’s a big supporter of municipal broadband and sees the Web as a place to promote more direct democracy in San Francisco.

Lonnie Holmes, a probation officer, has roots in the African American community and some credible ideas about violent crime. He favors extensive, direct intervention in at-risk communities and would fully fund recreation centers, after-school programs, and antiviolence education in elementary schools. He thinks a network of community resource centers in key neighborhoods could cut the crime rate in half. He’s a little conservative for our taste, but we like his energy, commitment, and ideas.

Harold Hoogasian, a third-generation florist, registered Republican, and small-business activist, is a self-proclaimed fiscal conservative and law-and-order guy who complains that the city budget has skyrocketed while services don’t seem to have improved. Yet somewhat to our surprise, he told us he supports the idea of a moratorium on market-rate housing and a ballot measure that would force developers to build housing more in tune with San Francisco’s real needs (even if he wants to start with ownership housing for cops). He supports public power, wants more sunshine in government, and opposes privatization. He also brings a much-needed critique of the remaining vestiges of machine politics in this one-party town and speaks passionately about the need for outsiders and political independents to have a seat at the table. We’re glad to have him in the race.

In the end, though, our picks in this first ranked-choice vote for San Francisco mayor are Mecke, Sumchai, and Rinaldi — on the issues, as a political statement, and to remind Newsom that his poll numbers don’t reflect the deep sense of distrust and discontent that remains in this city.

District attorney

KAMALA HARRIS


We’re always nervous about unopposed incumbents. And since Kamala Harris unseated Terence Hallinan four years ago, running as an ally of then-mayor Willie Brown with the backing of a corrupt old machine, we’ve been nervous about her.

In some ways she’s been a pleasant surprise. Harris quickly showed that she has courage and integrity when she refused to seek the death penalty for a cop killer despite the fact that the police rank and file and much of the brass excoriated her for it. She remains one of the few district attorneys in the nation who oppose the death penalty in all situations. She’s created a public integrity unit and aggressively filed charges against Sup. Ed Jew. She’s made clear to the Police Department that she won’t accept sloppy police work. She talks constantly about making crime and criminal justice a progressive issue.

But there are plenty of areas in which we remain nervous. Harris hasn’t been anywhere near as aggressive as she could be in prosecuting political corruption. She doesn’t pursue ethics violations or Sunshine Ordinance violations. The San Francisco DA’s Office could be a national leader in rooting out and prosecuting environmental and political crime, but it isn’t.

Meanwhile, the murder rate continues to rise in San Francisco, and Harris and the police are pointing fingers back and forth without actually finding a workable solution.

And lately, Harris, to her tremendous discredit, has been stepping up the prosecution of so-called quality-of-life crimes — which translates into harassing the homeless. She’s made sure there’s a full-time prosecutor in traffic court, pressing charges for things like public urination, sleeping in the park, and holding an open container of beer. That’s a colossal waste of law enforcement resources.

We expect a lot more from Harris in the next four years. But we’ll back her for another term.

Sheriff

MIKE HENNESSEY


Mike Hennessey has been sheriff for so long that it’s hard to imagine anyone else holding the job. And that’s not a bad thing: Hennessey is one of the most progressive law enforcement officers in the country. He’s turned the county jail into a center for drug rehabilitation, counseling, and education (the first charter high school in America for county prisoners is in the SF jail). He’s hired a remarkably diverse group of deputies and has worked to find alternatives to incarceration. He’s openly critical of the rate at which the San Francisco police are arresting people for small-time drug offenses ("We’re arresting too many people for drugs in the city," he told us). He took a courageous stand last year in opposing a draconian and ineffective state ballot initiative that would have kicked convicted sex offenders out of San Francisco and forced them to live in rural counties without access to support, services, or monitoring.

We’ve had some issues with Hennessey. We wanted a smaller new jail than he ultimately decided to build. And we really wish he’d be more outspoken on local law enforcement issues. Hennessey told us he wants to stick to his own turf, but if he were more visible on police reform, criminal justice, and law enforcement, the city would benefit immensely.

Hennessey’s only opponent is David Wong, a deputy sheriff who was unable to make a case for replacing the incumbent. We’re happy to endorse Hennessey for another term — but since this might be his last before retirement, we urge him to take his progressive views and push them onto a larger stage.

41st Anniversary Special: Wrecked park

The San Francisco Recreation and Park Department has a long history of maintaining parks, community centers, and other recreational offerings. In fact, it controls more land in the city than any other entity, public or private. But after seeing its budget repeatedly slashed during lean fiscal years, the underfunded department has become a prime target for some controversial privatization schemes.

There are ongoing efforts to privatize city golf courses, supported by Mayor Gavin Newsom and Rec and Park general manager Yomi Agunbiade (see “Bilking the Links,” page 22). And there are ongoing fears that the city intends to privatize its popular Camp Mather vacation spot, something the RPD studied a few years ago and Sup. Jake McGoldrick has fought and highlighted.

Rec and Park has identified $37 million in needs at Camp Mather — the product of a private study the agency has been unable to fully explain to the public (see “From Cabin to Castle,” 4/4/07) — but left Camp Mather off a big bond measure planned for February 2008.

“They say $37 million you need up here, and how much you got in there for the ballot measure? Zip, zero,” McGoldrick told the Guardian. “It’s a familiar pattern: you underfund the hell out of something, and then you turn around and say, ‘We, the public sector, cannot handle taking care of this.'<0x2009>”

Rec and Park spokesperson Rose Dennis denies there are plans to privatize Camp Mather or that its omission from the bond measure is telling. “Many people disagreed — including you — with the funding needs and whether we could back it up,” she explained as the reason for its omission from the bond measure.

In his Oct. 1 endorsement interview with the Guardian, Newsom said, “We actually made some commitments just this last week with Sup. McGoldrick to help support his efforts, because he’s very protective of Camp Mather, and I appreciate his leadership on this, to help resource some of the needs up there without privatizing, without moving in accordance with your fears.”

And while Newsom said he hoped to avoiding privatizing Camp Mather, he refused to say he wouldn’t: “I’m not suggesting it’s off the table, because I’m not necessarily sure that the conditions that exist today will be conditions that exist tomorrow, and I will always be open to argument.”

But at least the Camp Mather and golf arguments have been happening mostly in public. That’s what voters intended in 1983 when they passed Proposition J, which requires public hearings, a staff study, and a vote by the Board of Supervisors before city services can be privatized. Yet over the past couple of years, there’s been an effort to quietly shift operations at a half-dozen rec centers away from city programs and toward private nonprofits.

It’s called Rec Connect. Its supporters bill it as an innovative effort to bring much-needed recreation programs to underserved, low-income neighborhoods. “This is a pilot program to see if a collaboration between a community-based organization and a rec center yields a richer program and a more engaged community,” said Margaret Brodkin, director of the Department of Children, Youth and Their Families, which created the program and oversees that and other uses of the city’s Children’s Fund.

But to members of the Service Employees International Union Local 1021 — which includes most city employees and has filed grievances challenging Rec Connect — the program is a sneaky attempt to have underpaid, privately funded workers take over services that should be provided by city employees, who are better paid, unionized, and accountable to the public.

“The city took funds from the city’s coffers and gave them to the Department of Children, Youth and [Their] Families,” Margot Reed, a work-site organizer for the union, told the Guardian. “DCYF is using these funds, through Rec Connect, to contract out to private nonprofits work that rec staff were doing for a quarter of the cost.”

Brodkin was the longtime director of Coleman Advocates for Children and Youth — a perpetual thorn in the side of City Hall and the author of the measure that set aside some property taxes to create the Children’s Fund — before Newsom hired her to head the DCYF. She sees her current role as a continuation of her last one, and she sees Rec Connect as an enhancement of needed services rather than a privatization.

“There is a commitment that no jobs would be lost. I’m a big supporter of the public sector,” Brodkin said, while acknowledging that the RPD is chronically underfunded. “I am certainly aware of the resources issue at Rec and Park…. I’d be a happy camper if the Rec and Park budget was doubled. But I’d still believe in this program and say it offers a richer experience.”

Rec Connect began in 2005 with a study that looked at unmet recreational needs and evaluated facilities that might be good places to bring in community-based organizations to offer specialized classes. The whole program was financed through a mix of public funds and grants from private foundations. The three-year pilot program started just over a year ago.

“The Rec Connects,” Newsom told the Guardian, “are a way of leveraging resources and getting more of our CBOs involved and using these great assets and facilities, instead of limiting use to the way things have been done.”

Rec Connect director Jo Mestelle denied that the initiative is a privatization attempt.

“Rec and Park brings the facilities, the sports, and traditional recreation. The CBOs bring the youth-development perspective and nontraditional programming,” Mestelle said. “Hopefully, together we build a community that includes youth-leadership groups and advisory councils.”

Few would dispute the need for more after-school or other youth programs, particularly in the violence-plagued Western Addition, where some of the Rec Connect centers are. But the means of providing these programs is something new for San Francisco, starting with the fact that even though Mestelle works in the DCYF office, her salary is paid for entirely by private foundations.

That relationship and those funders aren’t posted anywhere or immediately available to the public, but Brodkin agreed to provide them to the Guardian. They include the Hellman Family Philanthropic Foundation ($50,000), the Hearst Foundation ($50,000), the San Francisco Foundation ($128,000), the Haas Foundation ($100,000), and the SH Cowell Foundation ($150,000).

Brodkin and Mestelle characterized those foundations as fairly unimpeachable, and Brodkin defended the arrangement as part of a national trend: “The thing that’s odd about SEIU’s perspective is this is happening all over.”

That’s precisely the point, SEIU’s Robert Haaland says.

“It’s been a strategy since the ’70s to, as [conservative activist] Grover Norquist calls it, ‘starve the beast,'<0x2009>” or defund government programs, Haaland said. “On a national level there is a lot going on that impacts us locally.”

Minutes from a recent Recreation and Park Commission meeting confirm that rec center directors have only about $1,000 each year to cover the cost of buying basketballs, team jerseys, referee whistles, and other basic sports and safety supplies. The SEIU grievance also notes that recreation staff positions have decreased by a third just as senior management positions increased by a third.

“We don’t have enough dollars for $20-an-hour rec center staff who are directly responsible for the kids and are well known to the community. We believe kids deserve great coaches, consistency, longevity, and commitment,” Reed said.

SEIU Local 1021 chapter president Larry McNesby is also the Rec and Park manager who oversees Palega Park, one of the Rec Connect sites. He told the Guardian that while his rec directors are “under pressure from the mayor to show him numbers of people that they are serving,” Rec and Park’s new online registration fails to reflect the “hundreds of drop-ins” that rec staff serve on a daily basis.

But he said the department has been set up to fail by chronic underfunding.

“I’d love Rec Connect and DCYF to be on a level playing field, because my directors could out-recreate theirs any day,” McNesby said. “You can’t just eliminate our jobs and replace them with someone who makes just above minimum wage.”

Actually, Brodkin and Mestelle note that negotiations with SEIU over Rec Connect have resulted in a guarantee that no jobs will be replaced and an agreement by the city as to 250 different tasks that the Rec Connect CBOs can’t perform. Still, they say the program brings innovation to a stagnant city agency.

“Before Rec Connect the rec centers always had a Ping-Pong table and some board games, but some of them were really poor, many were tired looking, none had computers or Internet. So we’ve had to think outside the box. Rec [and] Park is a big department, and it’s not always efficient,” Mestelle said.

Public records show that in 2006, the DCYF, whose primary function is to administer grants, sent $1 million in public money to Rec Connect from the Children’s Trust Fund, a pool of cash the city gathers each year by levying 3¢ per dollar of property tax.

Both Rec Connect and city workers stress the importance of offering a range of good programs to young people. “Our work is at a more social level,” McNesby says. “Every minute a kid spends in a rec center is a minute they’re not breaking into a car or victimizing someone or being victimized.”

The question is who should provide those programs. “It’s society’s value system that controls where the money goes,” Rec and Park spokesperson Dennis said. “It’s a really provocative discussion. There are some very compelling trade-offs argued in convincing fashion by intelligent people on both sides. These aren’t easy decisions.”

But the union people say that when it comes to Rec Connect, that discussion isn’t happening in public forums in a forthright way. As Reed said, “Gavin Newsom never went to the voters and said, ‘Here’s what we want to do: cut the rec staff and bring in private nonprofits.'”

Over the past few weeks almost every major news outlet in the country has reported on Blackwater, a private company the US government hired to do work in Iraq that was once the exclusive province of soldiers.

The deal hasn’t gone so well: on Sept. 16, Blackwater guards opened fire and, according to the Iraqi government, shot 25 civilians. The incident set off an international furor and has brought into focus the breadth of the company’s work for the US government. It’s prompted an investigation by the House Committee on Oversight and Government Reform, which showed that since 2001, Blackwater’s federal contracts have increased 80,000 percent. It’s revealed the massive pay inequalities between private security guards and US soldiers — the cost of one private guard could pay the salaries of six soldiers.

And it’s raised a question that’s critical to understanding how government increasingly works in the United States: should a private company be doing the work of the military?

Privatization of public services is all the rage in this country now, at all levels of government, from Washington DC to San Francisco. Supporters say the private sector can often work better and more efficiently than the old, bureaucratic, much-maligned government.

But Blackwater is a great example of the perils of privatization. And there are many more.

STARVE THE BEAST


Over the past few decades governments at all levels in this country have been in a near-perpetual state of deficit. Taxes are way down from their historic post–World War II levels, and except for a brief period during the tech boom, there is rarely enough money for even basic social services.

"It’s been a strategy since the ’70s to, as Grover Norquist calls it, ‘starve the beast,’<0x2009>" Robert Haaland, an organizer with Service Employees International Union Local 1021, told us.

And because politicians, even Democrats, are terrified of tax hikes, they’ve been looking for more efficient ways to use the money they have. The magic bullet goes by many names — privatization, public-private partnerships, competitive outsourcing, creative financing solutions — but the basic idea is to allow the power of competition, set free in an unregulated market, to provide the public with the best services at the lowest cost.

"To do or to buy is the question that all governments face," says Ken Jacobs, director of UC Berkeley’s Labor Center.

We’ve been buying. Since 2000, outsourcing of federal dollars has increased 100 percent, to $422 billion in taxpayer funds in 2006, according to a September study by the Washington DC US Public Interest Research Group. The US government is now the private sector’s largest customer.

San Francisco may be known as one of the most progressive cities in the country, but this town has also been wooed by public-private partnerships with promises of improvements to the golf courses, construction of a new power plant, and funding for the many civic needs we have.

PRIVATIZE MUNI?


Cheerleaders for privatization look at someone like Nathaniel Ford, executive director of San Francisco’s Metropolitan Transit Authority, and see everything that’s wrong with the public sector. Ford’s salary is nearly $300,000, plenty high enough to attract a talented leader. But the Muni system he runs keeps the average San Franciscan waiting on the corner in the morning, delivers that person to work at an unpredictable hour, and lurches them homeward every night aboard a standing-room-only bus. Nobody thinks Muni is performing well.

That makes the case for privatization seem almost appealing.

"The public has been schooled to think that government is the problem, not the solution," Elliott Sclar, professor of economics at Columbia University, told us. In his 2000 book on privatization, You Don’t Always Get What You Pay For: The Economics of Privatization (Cornell University), he writes, "American folk wisdom holds that, by and large, public service is uncaring, unbending, bureaucratic, and expensive, whereas competitively supplied private services such as FedEx are efficient and responsive."

Competition, the privatizers say, drives innovation. Less red tape means more efficiency. A lack of unions and collective bargaining agreements translates to lower labor costs. Large-scale multinational operations can reduce redundancy and streamline their processes — all of which adds up to a lean-running machine.

But this country has a lot of experience with privatization, and the record isn’t good.

One hundred years ago private companies did a lot of what we now call government work. "Contracting out was the way American cities carried out their governmental business ever since they grew beyond their small village beginnings," writes Moshe Adler, a Columbia professor of economics, in his 1999 paper The Origins of Governmental Production: Cleaning the Streets of New York by Contract During the 19th Century. At one time private companies provided firefighting, trash collection, and water supplies, to name just a few essential services.

But according to Adler, "By the end of the 19th century contracting out was a mature system that was already as good as it could possibly be. And it was precisely then that governmental production came to America. The realization that every possible improvement to contracting out had been tried led city after city to declare its failure."

For example, the 1906 earthquake and subsequent fires in San Francisco were what prodded the city to municipalize water service after the company charged with the task, Spring Valley Water, failed to deliver while the fires raged.

In Philadelphia as well as San Francisco, the business of firefighting was once very lucrative — for both the firefighting companies and the arsonists who were paid to set fires for the former to fight. And corruption was rampant. "Large amounts of public contracting out historically created lots of opportunities for fraud and nepotism," Jacobs said.

So public agencies stepped in to provide basic services as cheaply and uniformly as possible. Towns and cities took on the tasks of security with police and firefighting, education with schools and libraries, and sanitation with trash collection and wastewater treatment. Nationally, the federal government improved roads and transit, enacted Social Security benefits, and established a National Park System, among many other things.

And then, about 30 years ago, the pendulum started to swing the other way. Driven by University of Chicago economist Milton Friedman, enacted in a massive policy shift by Ronald Reagan, proliferated by Grover Norquist and the neocon agenda, and fully appreciated by corporations and private companies, privatization came back.

In Reagan’s first term, he cut taxes 25 percent overall; the rich got a 40 percent cut. Domestic spending fell by half a trillion dollars in the 1980s, although any savings were countered by a rise in the defense budget.

Harvard economist Lawrence Summers, quoted in Looking Back on the Reagan Presidency (Johns Hopkins University), put it this way: "The Reagan budgets will influence the government for the rest of this century. Just as the Great Society left an imprint of Federal commitment to help the indigent and equality of opportunity, the Reagan budget deficits will leave an imprint of non-involvement."

Such a massive realignment of money coupled with tax breaks too politically painful to reinstate led to a boom in the outsourcing of public services. Private companies began doing more municipal work, while nonprofit organizations tried to fill the gaps in funding for social services, welfare, housing, health care, and the environment.

The George W. Bush era has seen even more overt outsourcing. These days no-bid contracts are preferred, and at times government services are completely turned over to the private sector in "direct conversions," and the public agency that once did the job is not allowed to compete to keep it. The Washington Post recently reported that no-bid government contracts have tripled in the past six years.

This doesn’t really sound like the competitive free market espoused by the theory of privatization.

FLUNKING THE TEST


To field-test the primacy of privatization, the Reagan administration sponsored a transportation experiment in the early ’80s: Miami’s Metro-Dade Transit Agency got to compete against Greyhound. The two providers were each given five comparable transit routes to manage over three years, and 80 new buses were bought with a $7.5 million grant from the federal government.

After 18 months 30 of the Greyhound buses were so badly damaged that they had to be permanently pulled from service. Passenger complaints on the Greyhound line were up 100 percent, and ridership was down 31 percent over the course of a year.

Why? There was no incentive in Greyhound’s contract to maintain the equipment or retain riders. The company’s only goal was to deliver the cheapest service possible.

The Miami transit contract could have contained clauses calling for regular inspections or guaranteed ridership, but that would have significantly increased the cost of the work — perhaps to the point where it would have been competitive with what the city provided.

That’s an important lesson in privatization politics: when you add the cost of adequately protecting the public’s interest and monitoring contract compliance, the private sector doesn’t look so efficient.

Which is why many say privatization only succeeds as a theory — and why, for all the problems with Muni, no private company is likely to be able to do a better job.

"Market fundamentalists present an idealized, simpleminded notion of competitive markets in which buyers and sellers have equal knowledge," Sclar told us. "Anyone can be a buyer, anyone can be a seller, everyone can evaluate the quality of the good. In this never-never land, that’s often the way the case is made for privatization by this particular group of economists."

In the real world a number of issues arise when a service goes private. "Accountability gets to be a really big problem," Ellen Dannin, professor of law at Penn State University, said in an interview. "There are predictions about how much money will get saved through privatization, but no one ever goes back to check."

The September study by the US Public Interest Research Group profiled several companies that do government work, including Bank of America, LexisNexis, ChoicePoint, KBR (formerly Kellogg, Brown, and Root), General Electric, and Raytheon, and found instances of illegal behavior in all cases. There were often massive errors in the companies’ work.

Bank of America and LexisNexis had security breaches compromising the data of at least 1.5 million customers they were handling for the government. ChoicePoint allowed identity-theft scams amounting to more than $1 million in fraud. KBR overcharged the government millions of dollars for work in Iraq and Kuwait. GE made defective helicopter blades for the US military. Raytheon failed to fully test the systems of new aircraft. These companies are all still employed by the government.

When companies take over services that aren’t typically part of a competitive market, all sorts of unexpected problems occur. Jacobs points to the rash of contracting for busing services in cash-strapped school districts. Not only did costs eventually rise in many places, but when schools tried to go back to providing their own service, the skilled drivers who knew the routes, knew the kids, and were able to do much more than drive a bus were gone.

Sclar and Dannin agree that any service that lacks competition should be public. Sclar presented the example of electricity. "It’s a natural monopoly," he said. "Essentially it’s either going to be a well-regulated industry or it’s got to be done publicly."

Corporations exist to make money. And although graft, mismanagement, and scandal have always been present in City Halls around the country, in the end the legislative, judicial, and executive branches were not designed to generate profits. That alone means contracting out is financially dubious.

Hiring mercenaries is a classic example. "It costs the US government a lot more to hire contract employees as security guards in Iraq than to use American troops," Walter Pincus wrote in an Oct. 1 article in the Washington Post. "It comes down to the simple business equation of every transaction requiring a profit."

As Pincus details one of the many contracts between the security firm and the US, "Blackwater was a subcontractor to Regency, which was a subcontractor to another company, ESS, which was a subcontractor to Halliburton’s KBR subsidiary, the prime contractor for the Pentagon — and each company along the way was in the business to make a profit."

Blackwater charged Regency between $815 and $1,075 per day per security operative. Regency turned around and charged ESS a slightly higher average of $1,100. After that, the costs dissolve into the enormous bill that KBR regularly hands the federal government.

When the US Army is paying the bill the costs are far lower. An unmarried sergeant earns less than $100 a day. If you’re married, it’s less than $200. If you’re Gen. David H. Petraeus, it’s about $500 — less than Blackwater’s lowest-paid workers.

Very little about the Blackwater contracts would be known by anyone outside the company if it weren’t for the federal investigation, since private businesses are not subject to the same public-records laws as the federal government. They don’t have to open their books or publicize the details of their bids and contracts, and they often fiercely lobby against any regulations requiring this, which leaves the door wide open for corruption — which is what brought sunshine laws to government in the first place.

Sclar said that when it’s a good call to contract out, corporations, private companies, and nonprofits should be required to abide by public-records laws in addition to adhering to a five-year wait for employees departing the public sector for the private. "I think transparency should always be the goal," he said. "As much information as possible." If a company doesn’t want to make its records public, he told us, "[it shouldn’t] go after public work."

THE AIDS LESSON


Privatization comes in many forms and emerges for what often seem like good reasons.

In the early 1980s gay men in San Francisco were starting to get sick and die in large numbers — and the federal government didn’t care. There was no government agency addressing the AIDS crisis and almost no government funding. So the community came together and created a network of nonprofits that funded services, education, and research.

"The AIDS Foundation was founded in response to the epidemic at a time when there wasn’t a response from the federal government," Jeff Sheehy of the AIDS Research Center at UC San Francisco told us.

At first, activists all over the country praised the San Francisco model of AIDS services. Over time the nonprofits began to get government grants and contracts. But by the 1990s some realized that the nonprofit network was utterly lacking in public accountability. The same activists who had helped create the network had to struggle to get the organizations to hold public meetings, make records public, and answer community concerns.

That, Sheehy said, shouldn’t have come as a surprise.

"There isn’t that same degree of accountability that you would have" with the public sector, he told us. "SF General is not going to turn you away at the emergency room, but nonprofit hospitals are less and less interested in running ERs."

Sheehy said he’s seen cases where difficult clients have been banned from accessing help from nonprofits. Unlike at public institutions, "the burden is not on the agency to provide the service. It is with the client to get along with the agency," he said.

Sheehy outlines other issues: nonprofits run lean and are more apt to make cuts and resist unionization, which means workers are often paid less, there can be higher turnover, and upper management is often tasked with fundraising and grant writing and distanced from the fundamental work of the group. There’s no access to records or board meetings. "If service takes a sudden downward shift, what can you do?" Sheehy asks. "You can’t go to board meetings. You can’t access records. What’s your redress?"

And that perpetuates the problem of government not stepping up to the plate. More than half of the social services in San Francisco are run by nonprofits, a trend that isn’t abating.

"When the services are shifted from the public sector to the nonprofit sector," Sheehy said, "that capacity is lost forever from government."

THE LOTTERY TICKET


When Dannin teaches her students about privatization, she uses the analogy of personal finance. "If I find my income does not meet my expenses, I can cut my expenses, but there are certain things I have to have," she said. To meet those needs a person can get a second job. In the case of the government, it can raise taxes.

But "that is not an option governments see anymore," she told us. "So the third option is to buy a lottery ticket — and that’s what privatization is."

When a publicly owned road is leased for 99 years to a private company, the politician who cut the deal gets a huge chunk of cash up front to balance the local budget or meet another need. When the new owner of the road puts in a tollbooth to recoup costs, that’s the tax the politician, who may be long gone, refused to impose. What option does the voting driver have now?

Public goods, from which everyone presumably benefits, are frequently and easily falling out of the hands of government and into the hands of profit-driven companies. In New Orleans, charter schools have replaced all but four public schools. In about 15 municipalities public libraries are now managed by the privately owned Library Systems and Services. (In Jackson County, Ore., it’s being done for half the cost, but with half the staff and open half the hours.) At least 21 states are considering public-private partnerships to finance massive improvements to aging roads and bridges. User fees have increased in the national parks as rangers have been laid off and some of the work of park interpretation is picked up by private companies, as is the case with Alcatraz Island.

Dannin also asks her students to consider who really owns a job. The easy answer is the employer. "But there is another claimant of ownership of that job," she says. "That is the public. Employers depend on roads for their employees to drive to work, a public education system to train their workers. They depend on housing, police, the court system, the system of laws. That is a huge amount of infrastructure we tend not to think about.

"We live within an ecosystem. We’re having a hard time seeing that ecosystem, that infrastructure that we’re all in. That’s what your taxes pay for."

41st Anniversary Special: The privatization of San Francisco

William M. Tweed was one of the greatest crooks in American political history, a notorious Tammany Hall boss in New York who managed in the course of just a few years, starting in 1870, to steal more than $75 million (the equivalent of more than $1 billion today) from the city coffers. The way he did it was simple. As Elliott Sclar, a Columbia economist and expert on privatization, notes, Tweed took advantage of the fact that much of the work of city government was contracted out to private companies. Boss Tweed controlled the contracts; the contractors overcharged the city by vast sums and kicked back the money to Tammany Hall.

This is a rather extreme example, but not, Sclar argues, an atypical one: the worst corruption scandals in American history usually involve private contractors and public money. In fact, he argues, privatization is almost by its nature a recipe for scandal and corruption.

Nothing in the public sector — no incompetence, no waste, no bureaucratic bungling — begins to compare with what happens when private operators get their hands on public money. And the cost of monitoring contracts, making sure contractors don’t cheat or steal, and forcing them to act in ways that reflect the public interest is so high that it dwarfs any savings that privatization seems to offer.

That’s the message of the Guardian‘s 41st anniversary issue.

It’s relatively easy to investigate government malfeasance. The records are public, the players are visible, and the laws are on the side of the citizens.

But when Bruce B. Brugmann started the Guardian in 1966 with his wife, Jean Dibble, he realized that the real scandals often took place outside City Hall. They involved the real powerful interests, the giant corporations and big businesses that were coming to dominate the city’s skyline and its political life. The details were secretive, the money hidden.

One of the first big stories the paper broke, in 1969, involved perhaps the greatest privatization scandal in urban history, the tale of how Pacific Gas and Electric Co. had stolen San Francisco’s municipal power, to the tune of hundreds of millions of dollars. The famous Abe Ruef municipal graft scandals of the early 20th century, the Guardian wrote, were "peanuts, birdseed compared to this."

When I first came to work here, in 1982, Brugmann used to tell me that daily papers, which loved to try to expose some poor soul who was collecting two welfare checks or a homeless person who was running a panhandling scam, were missing the point. "If you look hard enough, you can always find a small-time welfare cheat," he’d tell me. "We want to know about corporate welfare, about the big guys who are stealing the millions."

And there were plenty.

In his new book Supercapitalism: The Transformation of Business, Democracy, and Everyday Life (Knopf), Robert Reich, the economist and former secretary of labor, argues that during the cold war, when American politicians railed against the socialist model of economic planning, this country actually had a carefully planned economy. The planning wasn’t done by elected officials; it was done by a handful of oligarchic corporations and military contractors.

Modern San Francisco was born in that same cauldron. During World War II, captains of industry and military planners took control of the city’s economy, directing resources into the shipyards, collecting labor from around the country to build and repair Navy vessels, and making sure the region was doing its part to defeat the Axis powers. It worked — and when the war ended the generals went away, but the business leaders stayed and quietly, behind closed doors, created a master plan for San Francisco. Downtown would become a new Manhattan, with high-rise office buildings and white-collar jobs. The East Bay and the Peninsula would be suburbs, with a rail line (BART) carrying the workers to their desks. Private developers, working under the redevelopment aegis, demolished low-income neighborhoods to build a new convention center and hotels.

Nobody ever held a public hearing on the master plan. And it wasn’t until the late 1960s that San Franciscans figured out what was going on.

By 1971 the fight against Manhattanization began to dominate the Guardian‘s political coverage. It would play center stage in San Francisco politics for two more decades. The paper ran stories about high-rises and freeways and environmental impact reports, but the real issue was the privatization of the city’s planning process.

Ronald Reagan soared into the White House in 1980, rolling over a collapsing Jimmy Carter and a demoralized, moribund Democratic Party. Reagan and his backers had an agenda: to dismantle American government as we knew it, to roll back the New Deal and the Great Society, to get the public sector out of the business of helping people and give the benefits to private business. "Government," Reagan announced, "isn’t the solution. Government is the problem."

The Guardian was firmly planted on the other side. We supported public power, public parks, public services, public accountability. We had no blinders about the flaws of government agencies — I spent much of my time in the early years writing about the mess that was Muni — but in the end we realized that at least the public sector carried the hope of reform. And we saw San Francisco as a beacon for the nation, a place where urban America could resist the Reagan doctrine.

Unfortunately, the mayor of San Francisco in the Reagan years might as well have been a Republican. Dianne Feinstein’s faith in the private sector rivaled that of the new president. She turned the city’s future over to the big real estate developers. She vetoed rent control and gave the landlords everything they wanted. And when the budget was tight, she ignored our demands that downtown pay its fair share and instead raised bus fares and cut library hours.

When gay men started dying of a strange new disease, there was no public money or service program to help them, from Washington DC or San Francisco. So the community was forced to build a private infrastructure to take care of people with AIDS — and years later, as Amanda Witherell notes in this issue, those private foundations became secretive and unaccountable.

In 1994 we got a tip that something funny was going on at the Presidio. The Sixth Army was leaving and turning perhaps the most valuable piece of urban real estate on Earth over to the National Park Service … in theory. In practice, we learned, some of the biggest corporations in town had come together with a different plan — to create a privatized park — and Rep. Nancy Pelosi was carrying their water. Every detail of the Presidio privatization made the front page of the Guardian — and still, the entire Democratic Party power structure (and much of the environmental movement) lined up behind Pelosi. Now we have a corporate park on public land, with that great pauper George Lucas winning a $60 million tax break to build a commercial office building in a national park.

And still, it continues.

Mayor Gavin Newsom, a rising star in the Democratic Party, who told us he’s no fan of privatization, demonstrated the opposite in one of his signature political campaigns this year: he tried (and is still trying) to turn over the city’s broadband infrastructure — something that will be as important in this century as highways and bridges were in the last — to a private company. That’s what the whole wi-fi deal (now on the ballot as Proposition J) is about; the city could easily and affordably create its own system to deliver cheap Internet access to every resident and business. Instead, Newsom wants the private sector to do the job.

The Department of Public Health is running public money through a private foundation in a truly shady deal. The mayor’s Connect programs operate as public-private partnerships. Newsom wants to privatize the city’s golf courses, and maybe Camp Mather. He’s prepared to give one of the worst corporations in the country — Clear Channel Communications — the right to build and sell ads on bus shelters (and nobody has ever explained to us why the city can’t do that job and keep all the revenue). Housing policy? That depends entirely on what the private sector wants — and when we challenged Newsom on that in a recent interview, he snidely proclaimed that the city simply has to follow the lead of the developers because "we don’t live in a socialist society."

This is not how the city of San Francisco ought to be behaving. Because when you give public land, public services, public institutions, and public planning initiatives to the private sector, you get high prices, backroom deals, secrecy, corruption — and a community that’s given up on the notion of government as part of the solution, not just part of the problem.

You start acting like the people who have been running Washington DC since 1980 — instead of promoting a city policy and culture that ought to be a loud, visible, proud, and shining example of a different kind of America.

Bilking the links

By now, even most non-golfing residents of San Francisco have heard the dire refrain coming out of City Hall: San Francisco’s public golf courses are sucking millions of dollars from the city treasury! Dozens of media stories have trumpeted these bleak pronouncements, and city leaders are using the shortfall to push for outsourcing control of the century-old open spaces. But a Guardian review of the “Golf Fund” shows that the links are not nearly as down and out as pro-privatization forces have led us to believe.

Recreation and Park Department accounting documents we obtained show revenues at the city’s six publicly-owned golf courses last year were up nearly $1.5 million from 2005-2006 and over $2.2 million dollars from 2004-2005, an increase of nearly 30 percent. But the costs of a lavish contract with a large, out-of-state golf management corporation have risen precipitously over the same time frame and drained off most of these new funds.

For the 2006-2007 fiscal year, the city shelled out more than $3.25 million to Kemper Sports Management to operate the pro shop and clubhouse at the Harding Park Golf Course and its nine-hole neighbor, Fleming. By comparison, in 2004-2005, Kemper’s tab at Harding and Fleming was a still eye-popping $2.07 million, but that number was nearly $1.2 million less than what the city had to pay last year. These increased costs, as well as a hefty loan repayment for Harding Park’s botched remodel in 2002 and 2003, have eaten up the links’ improved revenues and forced the city to throw in an extra $1.4 million from the General Fund to keep golf solvent.

“What’s going on up at Harding is a disaster,” Bob Killian told the Guardian. Killian ran the city’s golf operations profitably for two decades until 2001. “When I was in charge, we had contracts with various managers for the pro shops and the restaurants and they made us money. They paid us. Now, Harding is run at a deficit. Where the fuck is the money going? What’s it for? Nobody knows. It’s all this big secret … It’s a scandal.”

Kemper’s seven year deal is unique, to say the least. At every other publicly managed course, the city leases control of the pro shops and clubhouses to outside companies. In exchange for a flat fee paid into city coffers, those companies bear all the risk, and reap most of the rewards, for operating the facilities. But at Harding, the city pays the Illinois-based Kemper $192,000 a year, regardless of their performance, to act as an on-site manager, plus a 5% “incentive fee” for gross revenues over $6 million. But those guaranteed sums are only the beginning of the bill.

Kemper hires staff, rents golf carts, and orders the supplies to be sold in the pro shop and the clubhouse. Unlike the city’s lease arrangements at other courses, though, they bear none of the risk. They simply invoice the city for their expenses and the city signs the tab. And the tab just keeps growing.

One public golf insider who declined to be identified for fear of retribution grumbled, “They’ve got this enormous staff there, managers and assistant managers and assistants to assistants of managers. It’s a golf course, not a hospital! I hear the payroll for the restaurant alone is like $600,000. And it’s only open for one shift a day … They stock their pro shop with top of the line gear that just sits there. If they order 20 Arnold Palmer shirts and only sell two, who cares? The city still pays for all 20.”

In an email to the Guardian, Kemper’s general manager at Harding, Steve Argo, told us they have between 60 and 80 employees, depending on the season. Citing this seasonal variability and “competitive reasons,” he did not break those numbers down between management and non-management, as we requested.

Both Argo and Katharine Petrucione, Rec and Parks’ Chief Financial Officer, attributed much of the added costs at Harding to the opening of a new “permanent clubhouse” there in late 2005. Argo said the increased revenues from the clubhouse have “more than covered the city’s increase in payments.” But while Rec and Parks’ ledgers do show that concessions revenues at Harding and Fleming have gone up since the clubhouse opened, the increase in Kemper’s bill has gone up nearly as much. All in all, with Kemper’s multimillion dollar deal and loan payments for the over-budget remodel at the course, accounts still put the course at more $500,000 dollars in the red – even though a round of golf there now costs well over $100 and Kemper is still making a handsome profit.

It doesn’t end there. Petrucione said Kemper’s contract actually costs taxpayers even more than meets the eye. Because the company submits monthly and yearly budget projections, as well as reams of invoices and expenses for reimbursement, Rec and Park staffers spend hours examining Kemper’s paperwork and activities – essentially managing the manager. When we asked her for an accounting of how much the Kemper contract costs the city in staff hours for these oversight duties, Petrucione replied, “It definitely requires more time and effort … than a lease agreement [like those at every other course] would.”

During a recent radio interview, Sup. Jake McGoldrick called Rec and Park’s deal with Kemper, “The worst contract I’ve ever seen…We don’t have a golfer problem,” he added. “Golfers are coming out and playing. We have an accountancy problem.”

The golf insider we spoke with echoed McGoldrick’s sentiments, “Business is up like 30% this year, but Kemper’s contract is jeopardizing the whole department … If we redid the greens, tees and fairways [at the other courses besides Harding], just Band-aid stuff like that, we would have the premiere municipal system in the country. But instead they’ve given this cushy deal to a company from Chicago with no connection to San Francisco. It’s so unfair.”

Despite the controversy over Kemper’s all-expenses-paid arrangement, Mayor Gavin Newsom, Rec and Park general manager Yomi Agunbiade, and others at City Hall have been using the deficits largely brought on by Kemper’s contract to push for more private control over the city’s links. In June, the Mayor’s office put forward a plan to outsource not just clubhouse and pro shop management, but all golf operations at the city’s premiere courses, including Harding. The proposal was tabled after several contentious hearings at the Board of Supervisors, but many observers expect that it will make its way back to the Board in the near future.

“In a perfect scenario the city could [manage the courses efficiently] but the city has proven that it doesn’t have the ability to do it,” Supervisor Sean Elsbernd told us back in July. Elsbernd has been one of the most vocal supporters of bringing in private golf management.

But McGoldrick, Killian and other opponents of the idea point out that the city provided quality, inexpensive golf for nearly 100 years. They worry that private managers will find profit in higher greens fees, more part time workers, and lower salaries and less benefits for full time staff. But beyond those concerns, they see the Mayor’s plan as yet another example of publicly owned assets being offered up for private gain.

The courses, McGoldrick told us, are “priceless … we can’t just dump [them] because you’ve got folks from the Mayor’s office and his Rec and Park department who don’t want to be bothered.”

Why North Beach works

It’s time to piss some more people off, esp. the folks who think that highrise housing=urban density=good.

The Chronicle just announced that the American Planning Association has designated North Beach in SF as one of the best neighborhoods in American Why?

The 41,000-member organization took note of the atmospheric collage of low buildings around such historic gathering places as Grant Avenue and Washington Square. They also acknowledged the tenacious way that residents have fought to keep out chain stores and development projects that might water down “its eclectic mix of mom-and-pop shops, nightclubs and polyglot character (that) make it one of the city’s most unique and authentic communities,” according to the announcement.

What’s the message here? North Beach is dense — one of the densest parts of San Francisco. But it’s a real neighborhood, with local stores, locally owned businesses and local character.

And there are strict rules against chain stores.

Now check out the new highrises south of Market. The stores are all chains. There’s no neighborhood feel. It’s like someone dropped in a bunch of luxury hotels in a faux San Francisco setting.

If the city wants to build density, fine: But build real neighborhoods, with a mix of people, with local businesses, parks, street lfe. The highrises we’re building don’t do that.

Okay, commenters: let the attacks begin.
