FILM "Some of our most exquisite murders have been domestic, performed with tenderness in simple, homey places like the kitchen table," Alfred Hitchcock observed.

While Hitch was the doyen of everyday suspense — capturing the foreboding whistle of a boiling kettle or the pendulous noose formed by a necktie — his vision of the violent-domestic was hardly singular. This year’s Mill Valley Film Festival showcases two very different films dedicated to exploring the tenuous relationship between crime and the domestic front, in all its various incarnations.

In Noah Buschel’s traveling noir homage The Missing Person, a case of domestic subterfuge becomes a laconic meditation on loneliness and absolution in the post-9/11 New York City. Starring Michael Shannon (2008’s Revolutionary Road) as gin-soaked private investigator John Rosow, The Missing Person begins with the classic tropes of the Philip Marlowe feuilleton — a mysterious caller, aided by an attractive secretary (Amy Ryan), offers the down-and-out PI a sum of money to follow a unnamed man on a LA-bound express train from Chicago. The surly and self-deprecating Rosow immediately takes the case, though it appears his decision is motivated as much by boredom and a nasty hangover than by lucre. From a nearby compartment, Rosow surveils the very innocuous-looking mark who travels with a young, Hispanic child. Presuming the worst, the PI puts two and two together and speculates that he’s been hired to tail a serial pedophile. However, the story is much more complicated than it initially appears: a family has indeed been torn apart but it is not the one Rosow suspects.

While the meticulous narrative of Buschel’s film takes the de rigeur twists and turns of classic noir, The Missing Person‘s plot is, by and large, immaterial to its penetrating meditation on person and place. Despite his chronic dipsomania, Rosow is charming and witty, spinning slangy argot, gruff one-liners and double entendres around every chance encounter, as if he were some hybrid of Mike Hammer and Noël Coward. "I’m in the hide and seek business," he responds to a potential female conquest when asked of his profession. "That’s a game that kids play," she continues. "Well, if you add some money to it, it’s for adults," he shoots back. "Well, what are you doing – hiding or seeking?" she asks. "I’m drinking," Rosow concludes, finishing off his highball.

But Buschel is careful not to inundate his audience with a wisecracking "talkie;" rather he seduces them with long, silky strands of West Coast jazz — all saxophones and tinkling piano — as Rosow crisscrosses the parched sands outlying Los Angeles, lurches into an anonymous motel room in a drunken stupor, or fantasizes (in the rich cobalt shades of a Blue Note album cover) of a wife and life he left long ago. In other moments, Shannon’s ungainly frame and wall-eyed gaze dominates the frame, reacting and reflecting upon the sadness that appears to pervade his postlapsarian, cloak and dagger world.

If one is tempted to pronounce The Missing Person a unique and innovative form of filmmaking, it is because such deliberate care taken in the details: its soundtrack, cinematography and mise-en-scene are rarities in the slick, post-80s crime drama. Filmed on 16mm and bleached of the sharp hues common to contemporary cinema, the colors and textures of Ryan Samul’s cinematography have the odd, anachronistic feel of mid-70s neo-noir. The Conversation (1974), Chinatown (1974), and The Long Goodbye (1973) come to mind. All the more remarkable is The Missing Person‘s pastiche of cinematic influences in that they mingle seamlessly with images and stories of Manhattan, post-9/11, as the secret of Rosow’s mark is unearthed. When the hallowed spotlights of the WTC memorial appear at the film’s conclusion, they have the painterly senescence of a dog-eared comic book.

If Raymond Chandler bestows the focal literary references for Buschel’s opus, then Agatha Christie is the materfamilias of Larry Blamire’s "old dark house" spoof, Dark and Stormy Night. As Christie once quipped of her metier to a Life reporter, "I specialize in murders of quiet, domestic interest," and that is precisely what screwball director Blamire has in mind in this country-estate, will-reading-ensemble gone amok. Comprised of Bantam Street Film’s stock company, most of whom starred in Blamire’s previous Hollywood send-ups (including 2001’s The Lost Skeleton of Cadavra and 2007’s Trail of the Screaming Forehead), Dark and Stormy Night recreates every riff, trope, and motif of the late 30s genre — from the exterior miniatures to the canned special effects — all situated in a lavishly decorated and seemingly haunted house, replete with winding floor plan and secret passages.

A disparate crew of hopefuls have assembled at said estate to hear the pecuniary bequests of the late Sinas Cavinder during a particularly ominous evening, as the title promises. Among the crowd are competing reporters Eight O’Clock Farraday (Daniel Roebuck) and Billy Tuesday (Jennifer Blaire) hoping to land a hot scoop; demure ingenue Sabasha Fanmoore (Fay Masterson); brooding nephew Burling Famish, Jr. (Brian Howe) and his unfaithful wife, Pristy (Christine Romeo); the very Yiddish psychic Mrs. Cupcupboard (Alison Martin); the epigramming dandy Lord Partfine (Andrew Parks); and the hilariously-christened butler, Jeens (Bruce French).

As might be expected, a serious hitch in the evening arises when the secret addendum to Cavinder’s will is stolen and bodies begin piling up following the requisite "lights out" interlude. Unfortunately, a centuries-old phantom, the ghost of a dead witch, and an escaped maniac are all on the loose and vying for blood … and the only bridge off the estate has been washed away by the storm. So, whodunnit? The answer is not nearly as entertaining as the long night of sight gags, double-takes, screwball repartee, and an inexplicable, wandering gorilla Kogar (played by legendary prop master and gorilla-suit regular Bob Burns). Shot in HD with enough digital plug-ins to simulate RKO-era film stock, Dark and Stormy Night is as much a loving homage as parody. Late-night B-movie fans and nostalgics will enjoy just how light this "dark" comedy can be.

The national parks: A radical idea

I have two kids (with piano, gymnastics, tae kwon do, PTA and assorted play dates and sleepovers), a busy job, a dog to walk, dirty dishes to wash … you know the drill. So I haven’t been able to watch every minute of every episode of Ken Burns magnum opus on the national park system. I don’t think I know anyone who has that kind of time these days.

But I tuned in for a while last night, to Episode Two, which tracks John Muir, Teddy Roosevelt, the Antiquities Act etc., and I walked away with a very clear message:

This is a series about what government does right.

In the segment I saw, the feds were the good guys — Congress was saving wild areas, and when the western ranchers and developers tried to commercialize the Grand Canyon (in the name of private enterprise), Roosevelt used his authority to block them, infuriating the states-rights and anti-government Westerners but (of course) preserving what everyone know agrees is a national treasure.

There was a fabulous quote from environmental journalist Juanita Green.

“In other parts of the world,” she says, “there are places that are wild because some nobleman decreed it. In the United States, we don’t need a nobleman. … that’s democracy.”

At a time when the mayor of San Francisco is lauding the death of a billionaire who believed just the opposite — that the private sector should decide what gets saved and that private philanthropy (from fortunes built on tax cuts) is a better solution than public spending (fueled by taxes on the wealthy), we all ought to think about that a little.

If the national parks are “America’s best idea,” as Burns dubs his documentary, then the best thing this nation has ever done is exerted government supremacy over the private sector when it comes to the use of land. It’s sad to think how radical that sounds today.

Will Arnie’s ‘park closure solution’ save Candlestick Point?

Does San Francisco really need to sell Candlestick Point park for Lennar condos?

Governor Arnold Schwarzenegger has unveiled a plan to allow for all state parks to remain open without increasing Parks and Recreation budget appropriation. Does this mean the Bayview’s only major park can be saved? Developers are arguing that if the state sells a chunk of the waterfront property for $50 million, the rest of the park can be saved. But environmentalists disagree, noting that Lennar simply wants the land for luxury condos.

“Working closely with my Departments of Finance and Parks and Recreation, we have successfully found a way to avoid closing parks this year,” Schwarzenegger said in a press release today. “This is fantastic news for all Californians.”

But does this mean that Sen. Mark Leno’s SB 792 is no longer necessary?

Leno’s bill would allow the state to sell a chunk of Candlestick Point State Recreation Area for $50 million, so that developer Lennar, which has entered into a nebulous public-private partnership with the city of San Francisco, can build luxury condos on this waterfront parkland.

Leno’s bill, which the Assembly and the Senate have approved, is sitting on Arnie’s desk awaiting the governor’s signature. But it has faced stiff opposition from environmental groups in recent months.

And their neutrality was only recently secured, based on the spurious argument that, without the bill’s approval, Candlestick Point SRA would have to closed in its entirerity.

But now the Governor is proposing to reduce ongoing maintenance for the remainder of 2009-10, eliminate all major equipment purchases, and reduce hours and/or days of operation at most State Park units, expenditures on seasonal staff, and staffing and operations at State Parks headquarters.

According to Arnie’s proposal, some facilities could close weekdays and be open on weekends and holidays, or portions of a unit could be closed, such as the back loop of a campground. For a park with multiple campgrounds, one whole campground or day use facility could be closed while the rest of the park remains open, while parks that already close due to seasonal conditions could see longer closures.

“Service reductions will be planned to minimize disruptions to visitors, achieve cost savings and maintain park fee revenues,” the memo says.

Hmm. Seems like Arnie’s memo just gave Candlestick Point park supporters more ammo in their ongoing quest to challenge Lennar’s plan to take 23 acres of Candlestick Point SRA.

Lennar never spelled out this plan to take a chunk of the Bayview’s only major park, when they asked voters to approve Prop. G in 2008.

Instead, Prop. G was billed as a way to clean-up the abandoned Hunters Point shipyard and “create” hundreds of new acres of parkland.

It wasn’t until after Prop. G passed, that Lennar began publicly arguing that they would need 42 acres of the existing parkland, if the rest of their plan, which involves building 10,500 housing units on 770 acres of former industrial/ military land, is to pencil out. As for the new acres of parkland, that turned out to be acres of polluted shipyard that Lennar was proposing to cap with a cement cover and convert into a park.

Understandably angered, park advocates beat Lennar down to 23 acres, this fall, during the most recent round of the “parks for condos” battle.

Now, in light of Arnie’s plan and the soon-to-be released environmental impact report for Lennar’s massive redevelopment plan, those battlelines are perhaps, once again about to be redrawn. Only this time in favor of the park.

Amazing Park(ing) Day

San Francisco — and cities around the world — celebrated Park(ing) Day today in glorious fashion, transforming hundreds of automobile parking spaces (about 50 in SF alone) into mini-parks and works of art.

Among the highlights: the folks at Rebar, which founded the event here in 2005, made the rounds in their pedal-powered Parkcycle; Temple nightclub and Ritual Roasters each created lush lawns for lounging; SPUR worked with the Great Streets Project to extend the sidewalks with platforms and create a street party complete with DJ and belly dancers; Four Barrels Coffee turned car parking spots into bicycle parking spots; and Interstice Architects had a mobile forest that moved to various spots, including 826 Valencia in the afternoon. Downtown’s parks were said to be liveliest during lunch hour, whereas Mission area installations drew the most activity in the afternoon.

City Planning’s latest mess

EDITORIAL The San Francisco city planning director, John Rahaim, has kept a fairly low profile since taking over the troubled department in 2008. But some serious problems are starting to fester on his watch — and if he and the planning commissioners don’t clean up the mess, the supervisors need to step in.

Rahaim remains somewhat in the shadow of the former director, Dean Macris, who is responsible for some of the worst San Francisco development problems of the past three decades. And the Macris influence is still very heavy in the department. But Rahaim needs to step out and show that things are going to change. For starters, he should:

Scrap the plan to privatize environmental review. As Rebecca Bowe reports on page 15, the department is looking at bringing in outside consultants to help clear up the backlog in the Major Environmental Analysis division of the Planning Department. It’s a horrible idea — the environmental consulting firms that do this work make most of their money from developers, and that’s where their loyalties will always lie. The city planning staff is by no means perfect, but at least the unionized MEA staffers have some ability to demand that builders follow the rules and that environmental impact reports are relatively honest. The whole idea comes (not surprisingly) from the big developers, particularly Lennar Corp. at Hunters Point and the consortium looking to redevelop Treasure Island; they’re worried about the short-staffed Planning Department’s slow pace of project review. But we don’t see those developers helping raise new revenue for the city — money that could allow planning to hire more staff.

Back away from allowing developers to block sunlight in city parks. San Francisco voters approved a measure back in 1984 that essentially halted the construction of any tall buildings that would cast shadows on city parkland. Proposition K has worked remarkably well over the years. But now, with such behemoths as the 100-plus-story tower planned for the Transbay Terminal area and the high-rise condo complex near the Transamerica Building threatening to block out the sun in public open space, the developers are looking for ways to "update" — that is, gut — Prop. K protections. On Aug. 23, a who’s who list of big local developers, architects, and lawyers met with city planning officials to discuss the issue (the attendance list, and more background, is posted at sfbg.com). The Planning Commission will get a briefing on the topic Sept. 17.

We don’t see the problem with Prop. K — protecting parks from high-rise shadows is pretty basic planning and has been public policy for 25 years. Rahaim should drop this developer-driven plan, now.

Get Macris the hell out of the Planning Department. Mayor Gavin Newsom and the Planning Commission hired Rahaim a year and a half ago. So why does Macris, the former director, still have an office in the department? Why is he routinely consulted on major issues? When, oh when, will he finally go away?

According to the mayor’s press secretary, Nathan Ballard, Macris isn’t costing the city any money — a handful of developers are chipping in to cover the cost of his paycheck. That alone is a problem — since when do developers get to have their own paid planner sitting in on office in the Planning Department?

And frankly, Macris has been a shill for big developers all his career. He oversaw much of the massive over-construction that took place in the 1980s, and resisted all attempts at slowing down runaway growth. He’s a bad influence on the department, and Rahaim needs to send him packing, now.

Rahaim has gotten a fairly free ride so far, but things are starting to spiral out of control in his department. It’s a disturbing pattern, and the supervisors should be prepared to hold hearings and start taking action. *

Flash: Yee wants to sell the Cow Palace!

Okay, this is pretty radical:

State Sen. Leland Yee has been a bill that would force the Cow Palace, a state-owned operation, to sell 13 acres of land to Daly City. Okay, we’ve got some problems with that, but basically, the idea is to force the Cow Palace folks to negotiate a deal with a developer for a long-term lease so that neighborhood can get a supermarket and some other amenities.

But now, at the last minute, with only days left in the legislative session, Yee is trying to amend the bill to authorize the sale of the entire site — 63 acres of public land.

“We were hoping for a lease deal, but that hasn’t happened,” Adam Keigwin, Yee’s press spokesperson, told me. “That neighborhood has no grocery store. The land is currently underutilized. The governor wants us to include the entire parcel in the bill.”

So in cooperation with Gov. Schwarzenegger, Yee is preparing to allow the state to sell off 63 acres of public land. That’s a huge site, a vast amount of immensely valuable property in one of the densest urban areas in America.

Joe Barkett, CEO of the Cow Palace, is (not surprisingly) upset: “The Cow Palace is an historic institution with wonderful memories for many people,” he told me. “To try to sell it off in this manner is a disservice to the community.”

Keigwin notes that the bill doesn’t mandate that the Cow Palace be torn down; “all it would do is change the ownership.” And that might not happen right away; “the governor’s office agrees that this might not be the best time to sell.”

But the governor and Yee are also looking for cash to address the horrifying budget deficity, and this is one potential source of millions and millions of dollars.

The problem is that once you sell public land, it’s gone, forever. And with all the needs in San Francisco and Daly City — affordable housing, parks, cultural facilities as well as a supermarket — there ought to be a way to keep this in the public sector. I asked Keigwin about some sort of public development authority, and he agreed that was a nice idea, but “that’s never happened at the state level.”

Folks: This is a bad idea. I’m in full agreement that the site is underutilized, but I have this visceral opposition to selling off 63 acres of land to a private developer.

And if the Assembly goes along, this will happen in a matter of days.

The governor of California loves to talk about the state "living within its means." That, of course, means cutting education funding, closing state parks, stealing money from cities, wiping out hundreds of social programs, and never, ever, raising any taxes.

He has a different line on water.

The state’s economy is in a severe downturn, but California itself is far from broke. This is still a wealthy state. Between the big businesses and the rich individuals, there’s actually plenty of money in the overall economy to pay for schools and colleges and parks and health care. Defining our "means" as a level of spending that’s possible without raising taxes is a purely political decision that has nothing to do with economic reality. In fact, the California economy would be a lot better off today if Gov. Schwarzenegger hadn’t cut the vehicle license fee the day he took office. (Remember: public-sector jobs are just as legitimate a source of employment as private-sector jobs, and government spending is an excellent way to stimulate private growth.)

Freshwater, on the other hand, really is a finite resource. There’s only a certain amount of rain that falls on the state every year, only a certain amount of snowpack that melts in the spring, only a limited amount that can be stored in reservoirs. You can’t raise new water the way you can raise new revenue; even building new dams just takes water that would have gone downstream and holds it for another purpose.

The state’s freshwater has to meet a lot of demands. Farmers rely on it to irrigate crops — some of them crazy, unsustainable crops — in what is naturally a dry Serengeti. Giant cities and suburbs in the southern part of the state rely on it to fill swimming pools and water lawns. Most of the 38 million people who live in this state rely on precipitation runoff for their drinking water.

And if too much water from Northern California gets diverted before it reaches the Sacramento-San Joaquin Delta, then the complex, fragile ecosystem of the delta and the bay gets badly, maybe irreparably, damaged. And that has wide-reaching consequences (including the collapse of fisheries worth $250 million a year).

And yet, as Rebecca Bowe points out in this week’s cover story, the governor refuses to live within our hydrologic means.

It’s insane what’s been happening with the state’s water. Every year the Department of Water Resources offers to sell more water than the state actually has. In the severe drought of the early 1990s, water diversions from the delta were at record levels. In the current drought, diversions remain high. And that, the numbers suggest, is directly affecting fishing stocks. At this rate, there won’t be any salmon left in the delta in a few years. And that’s before the full impacts of global warming (and the likely decline in freshwater) play out.

Schwarzenegger’s solution: build more dams and a new canal to take more fresh water away from the delta.

The state Legislature is wrestling with a new water policy, and five bills are making the rounds. Some areas are getting desperate and trying what not long ago were considered nutty ideas — Marin County, for example, now wants to build a desalination plant, an expensive and energy-intensive way to get freshwater from the bay.

What nobody seems to want to say is that California, particularly the big agricultural operations in the Central Valley, simply waste too much water. The conservatives in the state capitol don’t believe in conservation.

Any serious Legislative plan has to start with a few fundamental facts. Freshwater flowing into the delta and out through the bay is not a wasted resource; the delta needs a lot more water than it’s currently getting to survive as an ecosystem. If that means the big water districts have to tell their clients to cut back on water use — using proven conservation methods and possibly switching to less water-intensive crops — then that’s a reality we’re going to have to live with. And more dams, canals, and pumping projects will just shift the problems from one part of the state to another.

California can survive on the water it has — if we stop the insanity.

‘Can I buy your park?’

Saul Bloom, executive director of Arc Ecology, recently donned his best suit and a sandwich-board saying "Can I buy your park?" then headed to some of the city’s most popular open spaces: Dolores Park, Golden Gate Park, Crissy Field, and Ocean Beach.

Bloom’s quest? Pose as a developer and videotape reactions to a fictitious proposal to sell 25 percent of the parks for housing, a ruse designed to illuminate how the city and its master developer, Lennar Corp., have never been nearly that honest about their plan to get the state to sell 25 percent of Candlestick Point State Recreation Area so Lennar can build luxury condos on prime waterfront parklands.

Predictably, responses to Bloom’s poll were mainly negative, occasionally violent. "A couple of people tried to clock me over the head," Bloom recalled. "They got aggressive. They said ‘You’re an asshole, man.’ But the predominant reaction was ‘I love my park.’ People asked, ‘Why do you want to sell them?’ They feel there’s not enough open space."

Perhaps the most chilling response came when Bloom told folks about the city’s actual plan to build condos at Candlestick Point SRA in the Bayview District. "Their response was, ‘Oh, it’s in the Bayview? Who cares?’" said Bloom, who fears that apparent indifference to the plight of the Bayview may explain why the city and Lennar see Candlestick Point SRA as a development opportunity.

Arc isn’t the only group accusing Lennar and the city of not properly informing the public that a vote for Proposition G, which was billed as the "clean-up the shipyard initiative" during the June 2008 election, was also a vote to push Senate Bill 792, state tidelands legislation that authorizes the Candlestick Point sell-off.

Introduced by State Sen. Mark Leno in February, SB 792 has since been amended and approved by the full Senate and is currently scheduled for a hearing by the Assembly Appropriations Committee Aug. 19. Passage by the committee is virtually certain, given that it only delays legislation based on fiscal impacts.

But even some Prop. G supporters, including Bloom, are now raising questions about the deal.

San Francisco’s Park, Recreation, and Open Space Advisory Committee (PROSAC) unanimously approved a resolution recommending that the city’s Recreation and Park Commission and the sponsor of SB 792 require both the city and Lennar to "provide detailed accounting of the park and open space acreage in the Candlestick Project." The committee asks that no net open space in the region be lost in the transfer.

PROSAC claims it was in the dark about the deal and asked those who pushed Prop. G to "provide documentation of when PROSAC and any other relevant advisory committees were informed of the intention to purchase state parkland for the Candlestick Project." So far Lennar and the city have pointed to conceptual maps and a couple of notices of public meetings as evidence that the public was adequately informed before voting.

But according to Bloom, who studies the maps and attends the meetings, "There really is not anything other than two graphics, neither of which call out the alteration to the park boundary. You’d really have to know what you were looking for. And why would the city’s own advisory committee be asking Lennar and the city for information if they were in fact told of this plan?"

Adding fuel to the fire is a July 21 resolution by Sups. Chris Daly and John Avalos, which argues that it should be official policy of San Francisco to oppose SB 792 in its current form and remind city lobbyist Lynn Suter "to accurately represent the City and County of San Francisco policy in Sacramento."

The resolution has been assigned to the board’s Land Use Committee and likely won’t be heard until September. It contends that SB 792 is "premature and preempts the process for public input and environmental assessment since the environmental impact reports for the proposed development on Candlestick Point and the Hunters Point Shipyard will not be released until the fall of 2009."

Noting that the state "purchased this beautiful waterfront parkland for $10 million in 1977," Daly and Avalos assert that "this land represents a valuable and irreplaceable asset to the state of California that should not be disposed of for private development."

The resolution notes that many people oppose the transfer "because of the impact of environmental racism caused by selling a clean park to a private developer for condominium construction denying Bayview Hunters Point residents equal access to healthy open space as is enjoyed by other neighborhoods in San Francisco."

As Daly told the Guardian, "Everyone wants the shipyard site cleaned up, development that works for the community, and real open space opportunities on the shoreline. And Prop. G was billed as doing this, which led to a division of people who believed Lennar and those who didn’t."

As a result, Daly said, people like Saul Bloom, who supported Prop. G, are coming out against SB 792. "So now, it seems, the skeptics are right," Daly said. "A lot of promises have been made. But unless you get them in writing, and have an insurance policy, Lennar is not delivering."

But Lennar Communities of California, the developer’s major political action committee, seems to be delivering when it comes to advocating for the park sell-off. In the second quarter of this year, Lennar more than doubled its spending on lobbying, including on SB 792. And Aug. 3, it alerted its Prop. G supporters that help is needed "passing SB 792 through the California State Legislature."

The e-mail blast claims that SB 792 is "straightforward and necessary legislation that reconfigures the state park boundaries at Candlestick Point and exchanges under-utilized land (most of it dirt, rubble, and a parking lot) for tens of millions of dollars of needed new improvements to the state park and a steady stream of dedicated funding to operate and maintain the improved park and open space."

But recently, there has been talk of an SB 792 compromise. According to insiders, the city and Lennar are willing to concede 20 acres of the contested 42-acres of park, although the developer insists it needs to build hundreds of condos (of which only 15 percent will be below market rate) on the 22 remaining acres of state park land if its entire 700-acre development is to pencil out.

Privately, environmental advocates say they may be unable to stop the land grab. And they worry that seven of the 20 acres Lennar is prepared to concede could be inundated by rising seas caused by global warming, as shown in a 2007 study by engineering firm Moffat & Nichol. It would be an ironic fate given Mayor Gavin Newsom’s July 30 announcement of a proposed United Nations center focused on climate change and green technology as part of Lennar’s project.

The Sierra Club opposes selling state parklands, building a bridge over Yosemite Slough, and capping a radiologically-affected dump on the shipyard’s Parcel E2. But the club does not oppose Lennar’s entire redevelopment plan. Arthur Feinstein, the group’s local representative, said, "We’re interested in saving as much land as possible. We are pushing to save the park’s grasslands. It’s existing habitat."

Noting that some amendments to SB 792 have been made, including removing proposed exchanges of parklands for shipyard land, Feinstein said that "there’s now a map that defines the project and no longer carries shipyard land."

Michael Cohen, Newsom’s chief economic adviser, said, "At Leno’s request, we’ve made amendments to address concerns, including taking steps to ensure there is no adverse impact on wildlife habitat."

Cohen called Newsom’s United Nations Climate Center "the perfect institution" for the entire redevelopment project, since it provides the shipyard with a green technology anchor. Cohen said he was unaware of the study showing the area could be flooded by global warming.

"But no one disagrees," Cohen continued, "that the state park will benefit from infrastructure and much needed capital for operations and maintenance."

Leno told the Guardian that his goal is to arrive at the best possible bill. "At the request of the opposition, we did amend the bill so that land at Hunters Point Shipyard won’t be part of any exchange," Leno said. "But it is conceivable that once the cleanup is completed, there could be a gift from the city to the State Parks Commission."

Leno said he hadn’t seen the flood map and joked, "If someone thinks they know exactly where the water is going to stop, they can place some bets now."

Assuming a more serious tone, Leno added that "the entire park system is under threat." He recalled how Gov. Arnold Schwarzenegger proposed to eliminate all General Fund money for parks and said, "We fought back and were able to restore most of the money."

But with the state’s ongoing fiscal woes and political stalemate, "Anyone who believes CPRSA is going to be open and funded indefinitely is not thinking clearly … so this deal has the potential for being an opportunity for our taking responsibility for the future of our state park system."

As currently drafted, SB 792 provides millions for improvements and $700,000 annually for operations and maintenance, Leno explained. "So I’m trying to make a bad situation better in a way that brings along this bill’s opponents so that they see that they are being taken seriously."

ANGELA CHAN

As staff attorney at the Asian Law Caucus, Angela Chan has been at the forefront of a yearlong effort to ensure that all undocumented juveniles have the right to due process in San Francisco.

That effort began last summer, shortly after Mayor Gavin Newsom, who had just decided to run for governor, announced that undocumented juveniles henceforth would be reported to federal authorities the minute they are booked on suspicion of having committed a felony — and before they can access an immigrant-rights lawyer.

These changes primarily affect Latino youth, but Chan, whose Cantonese-speaking parents ran a restaurant in Portland, Ore., sees the broader connections to other immigrant communities.

"I grew up in an immigrant community in a white working-class neighborhood," Chan explained. "I saw the barriers — language, culture, racism, xenophobia — and I realized that there was not a lot of power and awareness. I learned to appreciate civil rights."

As a teenager, Chan was determined to become an attorney. The temporary passage of California Prop. 187 — prohibiting undocumented immigrants from using social services, health care, and public education — intensified her determination. Chan graduated cum laude from Harvard Law School, and has been able to focus on this particular juvenile justice battle thanks to a Soros Justice Fellowship and the ALC’s "innovative, fluid, creative, and client-centered vision."

"I’ve tried different ways of challenging inequality — direct confrontation, anger — but I’ve found the best way is through policy, and being very educated and strategic," Chan said.

She said she’s hopeful that Sup. David Campos has the votes this summer to pass veto-proof amendments to the city’s undocumented-youth protection policy. As she put it: "People are starting to understand the difference between the juvenile and adult justice system and the issues around due process." (Sarah Phelan)

JULIAN DAVIS

Take a look at just a few of the things Julian Davis has done: He ran the 2008 public-power campaign. He’s on the board of San Francisco Tomorrow. He’s president of the Booker T. Washington Community Service Center. He’s a founder of the MoMagic Collaborative, which fights youth violence in the Western Addition. He’s on the board of the San Francisco Housing Development Corporation. He’s been appointed by the Board of Supervisors to serve on the Market-Octavia Citizens Advisory Committee. He’s a founder of the Osiris Coalition, which is working to ensure that public-housing tenants have the right to return to their homes after renovations. He’s hosted countless events for charities and political campaigns.

Then think about this: he’s only 30.

Davis grew up in Palo Alto, and moved to the corner of Haight and Fillmore after getting bachelor’s and master’s degrees in philosophy from Brown University. Philosophers weren’t exactly in demand at the time, so he wound up "playing my guitar on the streets for burrito money" while starting a PhD program at Stanford.

He also saw three people shot to death on his corner. "And I realized," he explained, "that the academic life wasn’t going to be for me."

Davis started organizing against community violence, and, inspired by Matt Gonzalez’s mayoral campaign, ran for supervisor in 2004. That got him started in local politics. He’s headed to law school at Hastings this fall, and it’s a safe bet that he’ll be a leader in the progressive political community for years to come. (Tim Redmond)

DAVID SCHOOLEY

"He’s a visionary. He’s very determined. He never gives up."

That’s how Ken McIntire, executive director of San Bruno Mountain Watch, describes David Schooley, who founded the Mountain Watch nonprofit four decades ago.

"For many years, David led every Sierra Club hike, organized every restoration party, and even took the bus to community fairs up and down the Peninsula so he could set up a table and distribute fliers about San Bruno Mountain," McIntire recalls.

Now snowy-haired and allegedly semiretired, Schooley, 65, remains as nimble as a goat when it comes to hiking across his beloved mountain, which rises and cuts across the Peninsula just south of San Francisco in San Mateo County — and whose ecosystem has been identified as one of 18 global biodiversity hotspots in need of protection

Schooley’s love for the mountain — which is covered with low-growing grasses, coastal sage, and scrub year-round and is dotted with wildflowers each spring — led him to found SBMW in 1969 and fight the expansion of the Guadalupe Valley Quarry and the growth of nearby Brisbane. Both were threatening to destroy the biggest urban open space in the United States and the habitat of rare butterflies, including the San Bruno elfin.

As Schooley explains, while the mountain is often hit with strong gusty winds and enveloped in thick fog, it is a great butterfly habitat and the last fragment of an entire ecosystem — the Franciscan region — the rest of which has been buried beneath San Francisco’s concrete footprints.

Two years ago, Schooley had the pleasure of once again finding the tiny raspberry-colored elfin caterpillars on some sedum (its host plant) on the north-facing upper benches of the quarry.

"It’s a miracle," Schooley told me at the time, delighted by this living example of nature’s ability to overcome human-made damage on the mountain.

At the time, Schooley was hoping the state park system would annex the property where the elfins were found. That hasn’t happened yet. But as McIntire says of Schooley (who dreams of a wildlife corridor that runs from the bay to the ocean), "David is always pushing for more open space around the mountain, for more nature and less development, and trying to reach a bigger audience." The San Francisco Mime Troupe is the conscience of the city, our proudest export, and — as it celebrates its 50th year — perhaps our most enduring sociopolitical institution. That’s a lot of kudos to heap on an artists’ collective, particularly one that delivers its theatrical social satire with such over-the-top comedy and music, but it isn’t a statement that we make lightly.

The SFMT embodies the very best San Francisco values — limitless creativity, a hunger for justice, courage under fire, an uncompromising commitment to creating a better world, and a progressive missionary zeal — and offers a powerful and entertaining reminder of those values every July 4, when it presents its new show in Dolores Park.

After it sings (and preaches) to the progressive choir of San Francisco, the troupe hits the road, visiting such less-than-enlightened outposts as the Central Valley and rural Northern California, delivering important messages to audiences that need to hear them most. "First of all, it’s humorous, so that breaks down a lot of barriers from the get-go," SFMT general manager Jenee Gill tells us.

But even here in the early ’60s, the San Francisco Recreation and Park Commission tried to use obscenity laws to ban the SFMT from performing in public parks. The troupe successfully fought the commission in court, setting an important free speech precedent. Modern San Francisco has grown up with the SFMT showing us the way forward with its uniquely high-stepping, knee-slapping, consciousness-raising style, and we’re a better city for it. (Steven T. BEST DANCE DYNAMO

You can’t miss him. He has legs like tree trunks and arm muscles that ripple like lava. When he leaps you think he’ll never come down, and his turns suggest the power of a hurricane. He is dancer Ramón Ramos Alayo, Six years ago he founded the CubaCaribe Festival that now packs in dance aficionados of all stripes, and he’s one of the shaping forces behind the wild San Francisco Carnaval celebration. He runs Alayo Dance Company, for which he choreographs contemporary works with Afro-Cuban roots, and he teaches all over the Bay Area — as many as 60 people show up for his Friday salsa classes at Dance Mission Theater. But Ramos is most strikingly unique as a performer. Ramos is as comfortable embodying Oshoshi, the forest hunter in the Yoruba mythology, as he is taking on "Grace Notes," a jazz improvisation with bassist Jeff Chambers. No wonder Bay Area choreographers as radically different as Joanna Haigood, Sara Shelton Mann, and Robert Moses have wanted to work with him.

Toshio Hirano packs a mean sucker punch. At first glance he’s a wonderfully eccentric Bay Area novelty, a yodeling Japanese cowboy playing native songs of the American heartland. Yet upon further inspection, it becomes as clear as the skies of Kentucky that Toshio is the real deal when it comes to getting deep into the Mississippi muck of Jimmie Rodgers-<\d>style bluegrass. Enchanted by the sound of American folk music as a Japanese college student, Toshio soon ventured stateside to spend years traveling and playing from Georgia to Nashville to Austin before finally settling in the Bay Area. Today, Toshio plays once a month at Amnesia’s free Bluegrass Mondays to standing-room-only crowds. Stay awhile to hear him play Hank Williams’s "Ramblin’ Man" or Rodgers’s "Blue Yodel No. 1(T for Texas)." It’ll clear that Toshio’s novelty is merely a hook — his true appeal lies in his ability to show that there’s a cowboy lurking inside all of us.

BEST COMMUNITY CHOREOGRAPHERS

A collective howl went up in 1995 when it was announced that the annual festival Black Choreographers: Moving into the 21st Century at Theater Artaud was ending due in part to lack of funding. But two East Bay dancers, Laura Elaine Ellis and Kendra Kimbrough Barnes, actually did something about it, working to ensure that African-American dancers and dance-makers received attention for the range and spirit of their work. It took 10 years, but in 2005, Ellis and Kimbrough Barnes helped launch Black Choreographers Festival: Here and Now, which takes place every February in San Francisco and Oakland. The three-week event is a fabulous way for a community to celebrate itself and to invite everyone to the party. While the choreographers’ range of talent and imagination has been impressive — and getting better every year — the performances are merely the icing on the cake. Master classes, mentoring opportunites for emerging artists, and a technical theater-training program for local high school and college students are building a dance infrastructure the next generation can plug into.

BEST MADCAP POP MAIDENS

San Francisco can always use another all-female band — and Grass Widow satisfies that need beautifully, cackling with brisk, madcap rhythms and rolling out a happy, crazy quilt of dissonant wails. Drummer-vocalist Lillian Maring, guitarist-vocalist Raven Mahon, and bassist-vocalist Hannah Lew are punk as fuck, of course — in the classic, pre-pre-packaged noncodified mode — though many will instead compare the trio’s inspired, decentered pop to dyed-in-the-bluestockings lo-fi riot grrrl. Still, there’s a highly conscious intensity to Grass Widow’s questioning of the digital givens that dominate life in the late ’00s, as they sing wistfully then rage raggedly amid accelerating rhythms and a roughly tumbling guitar line on "Green Screen," from their self-titled debut on Make a Mess: "Flying low into trees. We exist on the screen. Computer can you hear me? Understand more than 1s and 0s?" Grass Widow may sweetly entreat the listener, "Don’t make a scene," but if we’re lucky, these ladies will kick off a new generation of estrogen-enhanced music-making.

Karaoke is one of those silly-but-fun nightlife activities that always has the potential to be awesome but usually isn’t. The song lists at most karaoke bars suck, the sound systems are underwhelming, and no matter where you go there’s always some asshole bumming everyone out with painful renditions of Neil Diamond tearjerkers. Well, not anymore! Steve Hays, a.k.a. DJ Purple, is a karaoke DJ — or KJ — who has single-handedly turned the Bay Area’s once tired sing-along scene into a mother funkin’ party y’all. DJ Purple’s Karaoke Dance Party happens every Thursday night at Jack’s Club. Forget the sloppy drunks half-assing their way through Aerosmith and Beyoncé songs. DJ Purple’s Karaoke Dance Party is all about Iron Maiden, Snoop Dogg, Led Zeppelin, and Riskay. No slow songs allowed. An actual experienced DJ, Hays keeps the beats running smooth, fading and blending as each person stumbles onstage, and even stepping in for saxophone solos and backup vocals when a song calls for it. In this age of continual retro, it comes as a surprise that listening to mainstream ’90s alternative rock can give you, under the right inebriated circumstances, the kind of pleasure not experienced since heroin went out of vogue. Debaser at the Knockout has become one of the best monthly parties in San Francisco, largely because it gives ’80s babies, who were stuck playing Oregon Trail in computer class while Courtney Love and Kat Bjelland were rocking it out in Portland, the chance to live out their Nirvana-era dreams. Debaser promoter Jamie Jams is the only DJ in San Francisco who will spin the Cranberries after a Pavement song, and his inspired mixology is empirically proven to induce moshing en masse until last call, an enticingly dangerous sport now that lead-footed Doc Martens are back in style. Sporting flannel gets you comped, so for those still hung up over Jordan Catalano and the way he leans, Debaser is rife with contemporary, albeit less angsty, equivalents.

But it’s the decor that makes this place unique: Soviet-era and vintage tourism advertisements are sprinkled throughout the place and banners promoting Slovenian pride hang from the ceiling. Odds are you’ve not yet heard of East Bay teen hip-hop talent Yung Nittlz — but one day soon you will. The ambitious, gifted Berkeley High student has already amassed five albums worth of smooth and funky material that he wrote, produced, and rapped and sang on. In August 2007, when he was just 13, the rapper born Nyles Roberson scored media attention when Showtime at the Apollo auditions came to town and he was spotted very first in line, having camped out the night before. And while Yung Nittlz wasn’t among the lucky final few to be picked, he did make a lasting impression on the judges with his strong performance of the song "Money in the Air" and choreography that included him strategically tossing custom-made promo dollars that he designed and made. Founded in 2002, the many-membered Brass Liberation Orchestra has been blowing their horns for social justice all over the Bay Area — from the San Francisco May Day March and Oakland rallies for Oscar Grant, to protests against city budget cuts and jam sessions at the 16th Street BART station. Trombones out and bass drums at the ready, this tight-knit organization of funky folk recently returned from New Orleans, where they played to support community rebuilding projects in the Lower Ninth Ward. With a membership as diverse as they come, the BLO toots their horns specifically to "support political causes with particular emphasis on peace, and racial and social justice" — especially concerning immigrants’ rights and anti-gentrification issues. But the most joyful part of their practice is the spontaneous street parties they engender wherever they pop up, and their seemingly impromptu romps through neighborhoods and street festivals. There are, however, a few exceptions to the rule: true artists who have deliberately chosen the cabbie lifestyle because it allows them the freedom to pursue their passions on the side. BEST FRESH POETICS

The Bay Area knows poetry. And people in the Bay Area who know poetry today realize that the San Francisco Renaissance, the Beats, the Language poets, and even the New Brutalists might inspire contemporary writers, but they don’t own them. You can encounter proof in places like Books and Bookshelves, and read it in publications like Try. As the Bay Area Poetics anthology edited by Stephanie Young made clear in 2006, Bay Area verse is enormous and ever-changing. One year earlier, David Larsen established a space for it in Oakland with his New Yipes Reading Series, which frequently paired poets with filmmakers. He’s since moved to the East Coast, but Ali Warren and Brandon Brown re-energized the concept, simplifying its name to The New Reading Series and refining its content to readings with musical interludes. It’s the best place around to hear Tan Lin and Ariana Reines and confront notions of the self through Heath Ledger. It’s also hosted a kissing booth, for all you wordsmiths who aren’t above romantic trappings.

For 15 years, the much-loved and lovable warm weather Sunset parties have shaken various hills, isles, parks, patios, and boats with funky, techy house sounds. Launched by underground hero DJ Galen in 1994, the outdoor Sunset gigs have amassed a huge following of excited party newbies and familiar old-school ravers — and now even their kids. Early on in the game, Galen was soon joined by fellow Bay favorite DJs Solar and J-Bird, and the three — collectively known as Pacific Sound — have kept the vibe strong ever since. This year saw a remarkable expansion on the Sunset fan base: attendance at the season opener at Stafford Lake reached almost 4,000, and Pacific Sound just launched an annual — and truly moving — party on Treasure Island that had multiple generations putting their hands in the air. The recent Sunset Campout in Belden drew hundreds for an all-weekend romp with some of the biggest names in electronic music — true fresh air freshness.

BEST SECRET OF ETERNAL RAVE
According to murky local legend, sometime in the early ’90s a Finnish archaeologist named Mr. Floppy passed through Oakland on a quest to find an inverted pyramid rumored to hold the secret to eternal life. He didn’t find anything like that, of course, but he did discover a really cool apartment complex run by an obsessive builder named George Rowan. The sprawling place, which housed multiple dwelling units as well as an outdoor dance area and an out-of-use bordello and saloon famously frequented by Jack London in the 1800s, was an interconnected maze of rooms decorated with found objects and outsider art. It was a perfect spot to throw underground raves, which is exactly what Floppy and Rowan did until the day they got slapped with a fire-hazard citation. Nobody really knows what happened to the psychedelic archaeologist after that, although his spirit lives on: Mr. Floppy’s Flophouse has recently re-opened as a venue for noise shows, freaky circuses, and all-night moonlit orgies.

July 4 is Mime Troupe day in San Francisco, by tradition. Dolores Park, the place. There the venerable San Francisco company launches its annual free summer show — this year, the excellently timed and executed Too Big to Fail — surrounded by a varied throng of activists fanning out with ironing boards and literature among an audience of many hundreds basking in July rays, subversive laughter, and their own cheerful numbers.

Call it a day of independence from the usual bullshit, the jingo-jingle of national unity played for the masses from on high. This year Mime Troupe day got a city government imprimatur (making it actually "Mime Troupe Day" on official parchment somewhere) in a nod to the rabble-rousing satirical political theater troupe’s 50th year raising hell and inciting revolution. Generally speaking, when the government pats you on the back for that kind of thing, you want to check it didn’t leave behind a sticky with a bull’s eye. But the gesture seemed genuine enough. After all, the San Francisco Mime Troupe has in no small way contributed to the cultural clout the city enjoys as one-time font of the now revered (or at least hotly marketable) ’60s counterculture.

Founded in 1959 by RG Davis as a definitely not silent but highly physical instrument of radical aesthetic and political convictions, the Mime Troupe didn’t just mirror the counterculture; it was a driving force for it. And the free plays in the park — which began in 1962 and took the form of irreverent, politically charged reworkings of 16th-century commedia dell’arte scenarios and characters — were central to its aggressively popular, anti-bourgeois orientation.

From those early, gleefully spectacular free speech fights in Golden Gate Park — days when it was actually pitted in "obscenity" battles against the city government, in the form of the Parks Commission and the police — to clashes with cops and courts in Colorado and Canada over its still-provocative takes on American racism and civil rights in the guise of an old-fashioned minstrel show; to its midwifery of radical activist theaters like Teatro Campesino or anarchist rebels like the Diggers and their everything-free movement, it’s fair to say the Mime Troupe was more than a twinkling reflection of the zeitgeist.

Through the following four decades, the Mime Troupe, which became a collective in 1970, evolved and notably diversified with the times and their audiences, riding the vicissitudes of avid but also chaotic years, much of them spent touring extensively. Over what you might call three general and overlapping waves of collective leadership, it has endured. But has its mission?

"Absolutely," affirms Ed Holmes, a couple of days before the July 4 premiere. With the currently 10-member collective since 1986, Holmes is one of four members who came on in the mid- to late 1980s, and a powerful comedic performer revered for, among much else, his exquisite imitation of Dick Cheney. He fires off a definition: "To take a political analysis — radical, progressive, leftist, political analysis — make it entertaining, and take it out to the people in the parks, and give it away for free."

"The story’s the message," adds Pat Moran, a member since 2005 and the principal composer-lyricist of the Troupe since longtime member Bruce Barthol retired a few years ago. "But also the message is the going and setting up the show. The people working together, the people doing it, the fact that it’s produced every year on a slim budget with little time. That commitment is just as much a part of the show as the written piece."

Michael Gene Sullivan adds: "The audience should always leave any play, not just a Mime Troupe show, different people than they were when they entered. If they leave the same and are just entertained, the show is an abysmal failure." And how should they leave a Mime Troupe show exactly? "I want them to rush right out and overthrow capitalism," says Sullivan, the collective’s head writer since 2000, when he took the baton from longtime head writer Joan Holden. "That would be a good day."

At the same time, the challenges facing the company in 2009 are very real, most of them economic. Sullivan, with other members, points to the recent drastic yet financially necessary scaling-back of tours as a serious frustration. Bay Area living costs have also impinged on the day-to-day business of the organization, according to Ellen Callas. "People have had to take more and more outside work to fill in the gaps. It’s harder and harder to have a critical mass, even at meetings where important decisions are made," explains Callas, a member of the collective since 1986, "[But] none of us are willing to give up the dream of the Mime Troupe."

With their own building in the Mission District (purchased in the 1970s), unusual dedication, and commitments that include a teaching program for at-risk teens and workshop internships, the Mime Troupe does seem happily determined to press forward. Arthur Holden, veteran Trouper from the early 1960s until the 1990s, suggests it’s the collective structure of the Troupe itself that is key to its longevity — and no doubt part of its larger appeal too. "It’s what distinguishes the Mime Troupe from most other theaters: a sense of the collective members that they are really controlling their existence. That’s very important and it isn’t too easily found, in the theater or generally in the world."

Wow, and environmental issue that Ken Garcia can actually get excited about! The Examiner’s house curmudgeon, who loves to beat up on progressives, is outrages that the supervisors might consider putting parking meters in Golden Gate Park:

Our fabled greenbelt is about to become a money belt. Our forested treasure is about to be turned into a treasure chest.

The idea of sacrificing the beauty of Golden Gate Park to feed the fiscal hole created in part by the mayor and the board is ridiculous. Planting metal posts in our parks is a crime against nature.

Um, sorry Ken, but the “fabled greenbelt” is already a bit tainted — by thousands of cars that park along those “forested” streets every day. You want nature in the parks, fine — I’m with you. Close most of the East End to vehicle traffic and get rid of all the parking spaces. But no, Mr. Garcia never wants to mess with cars; he’s the most pro-automobile columnist in town.

He just wants people to be able to park in, and befoul, this urban treasure — for free.

(And by the way — I’m all for charging money for parking in GG Park — but I continue to wonder how long those nice, juicy meters plump with coins will last when it gets dark and hungry, and every creative, folks start thinking about all that spare change.)

The San Francisco supervisors made some significant changes to the budget and saved some $40 million worth of programs that the mayor wanted to cut or privatize, but the Newsom for governor ads will still be able to proclaim that the mayor solved his city’s budget problem without raising taxes or cutting police and firefighters.

Instead, this fall some 1,500 city employees are slated to be laid off, 400 of them in the Department of Public Health. Many recreation directors will get pink slips. Human services will lose at least 100 people. Nonprofit service providers will see much of their city funding disappear. The money to pay for public financing of the upcoming supervisorial and mayoral races is gone. Newsom’s pet (and expensive) 311 service will still be open 24 hours a day (with a lot of the money coming from Muni).

Not one of the city’s hugely redundant fire stations will close, even for a few days at a time. The bloated police budget will see no significant cuts, and the cops and firefighters will still get raises. The mayor will continue to employ five people in his press office.

And the only new revenue in the budget comes from fee increases on Muni, public parks, after-school programs, street fairs, restaurants, and the like.

Sup. John Avalos, chair of the Budget and Finance Committee, told us this was the best deal the supervisors could get, and it’s true that the board forced Newsom to add back a lot of money he wanted to cut. But the committee stopped far short of doing what it should have done — fundamentally changing the priorities of the Newsom budget.

Campos told us that he had "mixed feelings" about the deal and expressed concern about the board’s ability to shape midyear cuts and the lack of commitment from Newsom to support support placing revenue measures on the November ballot. Mirkarimi said he was happy with the dollar amounts of the add-backs but proposed holding in reserve some funding for the mayor’s pet projects — a tool for ensuring that Newsom consults with supervisors on the midyear cuts as promised — but Avalos opposed the idea.

Avalos said he’s relying on Newsom’s commitment to him: "The mayor has given me the assurance that he will not make unilateral decisions." But Newsom has a history of breaking such promises.

And the supervisors have not included any new tax revenue in the budget projections. Which puts San Francisco far behind Oakland.

The Oakland City Council has plenty of problems, and the mayor of Oakland, Ron Dellums, has been missing in action on a lot of the city’s problems lately. But when the mayor and the council had to address the budget problems, they came up with a solution that includes at least $6 million in new taxes. While that sounds like a small number, it’s almost 10 percent of Oakland’s budget shortfall. And the new taxes, which will need voter approval in a special July 21 election, are included as part of the budget plan for fiscal 2009-10.

Two of the new taxes — a levy on pot clubs (which the clubs themselves strongly support) and a loophole-closing measure that forces big businesses to pay their fair share of real estate transfer taxes — require only a simple majority vote to take effect. The reason: the council voted unanimously to declare a fiscal emergency and put the measures on the ballot. That allowed the city to avoid the state law that requires a two-thirds vote on most new taxes.

Measures C, D, F, and H make up a generally progressive package that has the support of Council Members Rebecca Kaplan and Jean Quan and Rep. Barbara Lee. We’re happy to endorse all four.

Measure C is a 3 percent increase in the city’s hotel tax, which would rise from 11 percent to 14 percent. Half the new money would go to the Oakland Convention and Visitors Bureau while the other half would be split between the Oakland Zoo, the Chabot Space and Science Center, and cultural arts programs and festivals in the city. We could argue with the distribution (arts festivals should probably get more money and the Visitors Bureau less) but overall, it raises the hotel tax to the level of most other cities in the area and would raise money for the sorts of programs hotel taxes typically fund.

Measure D is a technical amendment to the Oakland Kids First law that mandates spending on programs for children and youth. It changes the spending requirement from 1.5 percent of total city revenues to 3 percent of the general fund. That’s slightly less money than the program currently gets, but a lot more than it has had over the past decade. The coalition that put Kids First on the ballot in 1996 (and modified it in 2008) supports this modest change.

Measure F is a creative new tax. It would impose a 1.8 percent gross receipts tax ($18 per $1,000 in sales) on medical marijuana businesses. Most efforts to hike business taxes face bitter opposition from business owners, but in this case, the pot clubs are happy to pay. In fact, the four dispensaries in Oakland are among the measure’s strongest supporters. Paying taxes tends to legitimize the clubs — and while it’s going to be tricky to track sales in what is still largely a cash business where records have in the past been kept vague to avoid the threat of federal prosecution, this is a strong step in the right direction.

Measure H would prevent big corporations from cheating Oakland out of real estate transfer taxes. Under current law, a business that owns property in Oakland and is bought by another business (or becomes part of a merger) doesn’t have to pay transfer taxes on the property it owns. Closing that loophole could bring in as much as $4.4 million a year.

There’s a lesson here for the much larger city across the Bay.

San Francisco desperately needs new revenue. And while the mayor has talked, in vague terms, about maybe supporting some sort of tax measures in November, he hasn’t committed to anything. There are several proposals floating around the board, the latest of which is a Labor Council-supported tax on alcohol consumption, but no coherent package. The progressives on the board — both those who support the compromise Newsom budget and those who don’t — need to set aside those differences, now, and get to work on finding ways to bring in enough new money to deal with the impacts of further state cuts and stave off some of the layoffs slated for the fall.

The main obstacles are Sups. Sean Elsbernd and Michela Alioto-Pier. Everyone who cares about saving services in this city needs to pressure them to back away from their GOP-style no-new-taxes stands. If those two would at least agree to let the voters decide on new revenue measures, the city would likely get a unanimous board — and the ability to raise taxes with a simple majority vote.

Oakland’s pot club tax and real estate transfer tax are great ideas that can be directly imported to San Francisco. The city’s business tax could be made more progressive (and bring in new revenue) with a simple change in the tax rates (higher on the big outfits, lower on the small ones). We’re dubious about a sales tax increase — even a half-percent hike would bring the local tax rate to 10 percent. And, even though the alcohol tax isn’t exactly progressive, those ideas could be acceptable as part of a package.

The main thing is that the city will need, at minimum, another $100 million this fall, and probably ought to be looking at raising twice that much. Oakland — a city with far fewer resources, a much smaller business base, and radically less wealth — is managing to fight its deficit with progressive taxes. What’s wrong with San Francisco?

P.S.: Sup. Chris Daly was outspoken in his criticism of the budget deal, blasting Newsom and even taking on his former aide and longtime ally, Avalos. But for all his bluster about the mayor, Daly couldn’t bring himself to oppose Anson Moran, Newsom’s nominee for the Public Utilities Commission. Moran was a staunch ally of Pacific Gas and Electric Co. when he was the PUC’s general manager, and the full board should reject him. *

Bicyclists throughout the city cheered as the San Francisco Municipal Transportation Agency board unanimously approved 45 new bike-network improvement projects June 26, a move that was hailed as a major step forward for cyclist safety on city streets and a win for the environment.

In a historic decision, SFMTA accepted the findings of an environmental impact review associated with the long-stalled San Francisco Bike Plan and green-lighted almost all of its near-term project proposals, a decision that could trigger the construction of 34 new miles of bike lanes throughout the city starting as early as August.

Plans also call for innovative improvements such as colored bike lanes, converting on-street parking spaces from cars to bikes, thousands of new bike racks, and an effort to ramp up education about safety for bicyclists and motorists. Three years after a court injunction came down on bike-network improvements in the wake of a lawsuit for failing to conduct a full EIR, the board’s vote was widely applauded as a pivotal moment for bicycling in San Francisco. Now that the EIR has been adopted, the process of lifting the injunction has been set in motion.

The vote followed more than three hours of testimony from avid San Francisco cyclists, who asked for more bike lanes and greater accessibility for would-be bicyclists such as children and seniors. Fewer than 20 people turned out in opposition and most people on the thumbs-down side voiced their general support for enhanced bike lanes, but took issue with some flawed aspects of one of the projects.

For a comprehensive design that could ultimately remove more than 2,000 parking spaces from city streets to accommodate bicycle infrastructure, there was remarkably little discussion about the loss of parking.

An old familiar debate about bikes vs. cars continues to grind away — but even Mayor Gavin Newsom called this squabble a thing of the past, touting the Bike Plan as progress for San Francisco and focusing his comments at a press conference on sustainability and livability instead the competition for space on city streets.

IF YOU BUILD IT …


Moments after the MTA Board announced its decision, a crowd of die-hard bike enthusiasts from the San Francisco Bicycle Coalition exchanged hugs and congratulations outside the City Hall hearing room. The vote was hailed as a major, hard-won victory.

"This is a momentous day for better bicycling and a better San Francisco," said Leah Shahum, executive director of the 10,000-member organization. The city "has taken a significant step forward in proving its commitment to smart, sustainable transportation choices, and we expect to see the numbers of people choosing to bicycle to increase dramatically."

Still, there are undoubtedly some who only expect to experience a dramatic increase in frustration when looking for a parking space. There are 880 lane-miles of streets in San Francisco’s roadway network, and according to SFMTA spokesman Judson True, a total of 880 parking spaces throughout the city would’ve been removed if the MTA Board had approved all 46 Bike Plan projects. (The board okayed 45 out of 46 projects; the hotly debated Second Street project, which would have stripped out a handful of parking spaces to accommodate bike lanes, was continued for further study.)

Amid the hundreds of pages of comments submitted during the EIR process was a complaint that the Bike Plan — often touted as a win for sustainability — could adversely impact San Francisco’s air quality by causing more drivers to circle in search of parking.

"More time will be spent by persons in cars as a result of a lack of on-street parking (already at a critical lack of capacity) searching for an available parking spot or stuck in traffic jams due to removal of car traffic lanes," one member of the public complained.

In response, the EIR points to San Francisco’s Transit First policy, which essentially says that the city will provide more of an incentive to take public transit than drive. "The social inconvenience of parking deficits, such as having to hunt for scarce parking spaces, is not an environmental impact," the EIR notes. "There may be secondary physical environmental impacts such as increased traffic congestion at intersections, air quality impacts, safety impacts, or noise impacts caused by congestion. In the experience of San Francisco transportation planners, however, the absence of a ready supply of parking spaces, combined with available alternatives to auto travel … induces many drivers to seek and find alternative parking facilities, shift to other modes of travel, or change their overall travel habits. Any such resulting shifts to transit service in particular, would be in keeping with the city’s Transit First Policy."

The underlying idea is that the Bike Plan can help to clear the air, fight climate change, and boost public health by making it more convenient to go without a vehicle — and more of a headache to drive.

As one commenter pointed out, the Bike Plan could also make life easier for people with disabilities who have to drive by replacing cars with bikes and thus freeing space in traffic lanes.

BRAKING THE HABIT


There are, of course, many sound arguments for nudging people away from driving. At a June 26 press conference, Newsom noted that 54 percent of the city’s greenhouse-gas emissions are related to vehicle traffic on the city’s roadways — and reducing those carbon emissions would go a long way toward making the city more climate-friendly, not to mention healthier for cyclists and non-cyclists alike.

Meanwhile, Bert Hill, chair of the city’s Bicycle Advisory Committee, noted that 40 percent of car trips in the city cover two miles or less, a distance easily traversed by bicycle. If more people opt to go by bike, the result could be calmer traffic, cleaner air, and possibly a boost for business. "No one goes shopping on the highway," one commenter pointed out during the SFMTA Board hearing. For all of these overarching benefits to be realized, of course, many motorists will have to change their behavior by electing to leave the car at home.

The San Francisco Bicycle Coalition points to evidence suggesting that many frequent drivers are in fact ready to transform into frequent bicyclists. "New bike lanes will … attract tens of thousands of new bicyclists," an SFBC press release noted. "More than one-third of San Franciscans say they would ride if streets had more bike lanes and were more inviting for bicycling."

Newsom sounded a similar note, calling the Bike Plan "inevitable" and asserting that the debate that "used to be framed in terms of two wheels vs. four … that is behind us." Instead, he added, it’s time for "a new narrative of collaboration and partnership" between people who share the road.

Still, a battle continues to be waged against the implementation of the Bike Plan. Mary Miles, the attorney responsible for securing the three-year Bike Plan injunction (see "Stationary biking," 5/16/07), momentarily ruined the party at the SFMTA hearing by showing up, casting an icy glare, and warning the SFMTA board to "just stop now. We are appealing these actions." In the overflow room on City Hall’s first floor, Miles’ comments elicited hoots of laughter from a crowd of cyclists.

Miles’ client, Rob Anderson, is known for his cynical view that most people will never be encouraged to ride a bike, and that the Bike Plan unfairly rewards cyclists, a "special interest" group, at the expense of the majority of people, who drive.

Anderson and Miles are expected to appeal the SFMTA’s decision, possibly throwing one last monkey wrench into the process of moving the Bike Plan forward. Construction of new bike lanes can’t begin until the legal issues are resolved and the injunction is lifted.

PARK(ING) IT


A frantic driver who has just found a parking space might be thrilled to seize it, but Matthew Passmore has sparked a different sort of appreciation for parking spaces. One of the founders of Park(ing) Day, Passmore helped draw international interest in 2005 by temporarily transforming a parking space in the Mission District into a public park.

Since then the trend has caught on all over the world: all it takes is some Astroturf, a couch, and a few coins to pay the meter fare — and suddenly the public space usually reserved for cars is transformed into an attractive mini-park for pedestrians and passers-by.

The Park(ing) Day exercise, an event that takes place in September, has since prompted the creation of some 600 parks, free clinics, and other temporary "spaces" as part of the wider commentary about the allocation of public space. In Passmore’s view, "far too much of our city is dedicated to the automobile," and Park(ing) Day is just one way of illustrating this point.

For the soon-to-be 79 miles of bike lanes in the city, after all, there are still 880 lane miles built for cars, and San Francisco streets still accommodate a whopping 320,000 parking spaces. For his part, Passmore characterizes the removal of a few parking spaces as mere "growing pains," but emphasizes that in the long run, the Bike Plan will benefit everyone — not just cyclists.

For 15 years, the much-loved and lovable warm-weather Sunset parties have shaken various hills, isles, parks, patios, and boats with funky, techy house sounds. Launched by underground hero DJ Galen in 1994 (has it really been that long?), the outdoor Sunset gigs have amassed a huge following of excited party newbies and familiar old-school faces — and now their kids! Early on in the game, Galen was joined by fellow Bay favorite DJs Solar and J-Bird, and the three — collectively known as Pacific Sound (www.pacificsound.net) — have kept the vibe strong ever since. This year saw a remarkable expansion on the Sunset fan base: attendance at the season opener at Stafford Lake reached almost 4,000, and Pacific Sound just launched an annual — and truly moving — party on Treasure Island that had multiple generations putting their hands in the air. "The vision was to take electronic music out of the dirty warehouses, away from the dodgy promoters, and into the sunshine," says J-Bird. Summer’s just begun, and Pacific Sound, with several gangbuster parties lined up, keeps delivering.

SFBG You guys have been a major part of the party scene here for a while. What do you think of it right now?

Pacific Sound There’s a foundation for creativity in San Francisco — that is something that will never change. Also, there definitely is quite a bit more international talent coming here than 10 years ago. It’s this constant exposure to musical stylings from around the world that will facilitate a thriving scene. The recent crackdowns by the SFPD and ABC may be dampening some spirits, but it will never stop our creative heritage.

Selling the park

GREEN CITY Considering that it exists just a short hop from the industrial grind of Third Street, Candlestick Point State Recreation Area is a surprisingly wild and peaceful 150-acre bayshore park.

On a recent afternoon, a man practiced his golf swings, a group fished off a pier, and a lizard darted across a trail and into a clump of wildflowers, all apparently unaware of the storm gathering around the future of this waterfront habitat.

State Sen. Mark Leno’s Senate Bill 792 would give the State Lands Commission and State Parks Department the authority to negotiate an exchange of 42 acres in the park for patches of land on the former Hunters Point Naval Shipyard, allowing Lennar Corp. to build condos in the state park and reducing Bayview’s only major open space by 25 percent.

Leno claims that SB 792 "will help realize one of the few remaining opportunities for large-scale affordable housing, parks, open space, and economic development in San Francisco by authorizing a key public-private land exchange necessary for the development of Hunters Point/Candlestick Park."

"A lot of this property is dirt, and much of it is used by the 49ers for parking. It’s not high quality park land," Leno told the Guardian.

In addition to adding some amendments suggested by the Sierra Club, Leno said state and federal agencies must approve the deal, which would also require a full environmental impact report. "There will be no environmental shortcutting," Leno said.

But environmental advocates are outraged that Mayor Gavin Newsom and his chief economic advisor, Michael Cohen, are trying to get state legislators to facilitate an unpopular land swap that allows an out-of-state developer to build thousands of condos on state tidelands in exchange for strips and pockets of the toxic shipyard (see "Eliminating dissent," 6/17).

"When Michael Cohen asked us to endorse what they were calling a conceptual framework, he called it a rush to the starting line and promised us a full and robust discussion of the actual proposal," Kristine Enea, who works for the India Basin Neighborhood Association, said of last year’s Proposition G. "We’re not trying to stop the development, but we want a discussion. And we’re raising questions that otherwise won’t be raised until after the environmental impact report is completed."

In April, Newsom wrote to Sen. Fran Pavley, who chairs the state’s Senate Committee on Natural Resources and Water, claiming that plans for the shipyard and Candlestick Point had already been endorsed by the San Francisco Board of Supervisors and overwhelmingly approved by voters in June 2008.

"By utilizing a true public-private partnership, this [SB 792] will cause tens of millions of dollars of public open space investment to state park lands and public trust lands, at no cost to the state or the city’s general fund, providing a significant benefit to the state as well as to the citizens of San Francisco," Newsom wrote.

As part of the land swap, Lennar would pay fair market value for much of the parkland, with estimates of about $40 million that would go to the state for managing the remaining acreage. Lennar proposes to build 7,850 housing units on Candlestick Point, and it’s unclear how many of those will go into what is now a state park.

Critics say Newsom is trying to use Prop. G like a hammer to force through legislation that wouldn’t pass locally and would destroy the park’s current functions and wildlife habitat, forever changing life in Bayview Hunters Point, due to the scale and socioeconomic and environmental impacts of Lennar’s proposed redevelopment.

Created by the legislature in 1977, CPSRA is the state’s first urban park. It offers panoramic views of the wind-whipped bay, San Bruno Mountain, and Yosemite Slough, the only unbridged waterway in the city’s southeast sector. And while it’s not typically crowded, the park is well-used by residents, who like to hike and jog, walk their dogs, and windsurf adjacent to Monster Park stadium.

Saul Bloom — whose nonprofit group, Arc Ecology, angered Cohen and Newsom in February when it published "Alternatives for Study," a draft report that identified deficiencies in Lennar’s current proposal — admits that a section of the park is a weed-filled lot that 49ers fans use for parking on game days.

"But the leasing for parking contributes $800,000 toward park maintenance annually," Bloom told the Guardian, noting that this is a vital source of funding in tough times.

He also noted that the California State Parks Foundation recently raised $12 million to restore Yosemite Slough and the California Solid Waste Management Board (whose members include former Sen. Carole Migden, whom Leno defeated last year) recently completed a $1 million rehabilitation of a former construction debris field on the state park property.

But neither this nor the state Budget Conference Committee’s recent decision to institute a $15 surcharge on vehicle license fees of noncommercial vehicles as a dedicated funding source to keep California’s state parks open will save CPSRA from being hobbled if SB 792 is approved in its current state.

"Surely other land can be used for building condos. Affordable housing and condo residents need open space too," said Peter Barstow, founding director of Nature in the City, noting that the 42-acre parcel of contested land represents 25 percent of the park, but only 5 percent of the 770 acres the developer has at its disposal to build 10,500 units of proposed housing.

"Any loss in acreage would seriously diminish the ability of the park to serve the city’s needs, especially with 10,500 new units proposed for the Lennar development," Barstow said.

He said some "logical swapping" is possible. "But they are doing some numbers game, in which they are counting a huge amount of parkland that is already there."

"We should be thinking how to connect these ecologically isolated islands," Barstow said, who sees this debate as an opportunity to link CPSRA to wildlife corridors in McClaren Park and Bayview Hill. "The development should be in the interest of the people, critters, wildlife and plants in the Bayview, not in those of someone in an office thousands of miles away."

He also scoffed at proponents’ arguments that the density of the development means that it is smart urban growth. "Just because a development is dense is not an argument to build it on a park."

Cohen recently told the Guardian that the 77 acres of the 49ers stadium and all the paid parking inside its facility will be filled with "mainly retail and entertainment," while the 42 acres of state park would be used to build condos.

Meredith Thomas of the Neighborhood Parks Council noted that her group "fully supports the revitalization and redevelopment of the Candlestick Point/Shipyard area … But when folks voted for Prop. G in June 2008, nowhere did the measure say that by voting for it, you are agreeing to sell parkland."

"We are always concerned when municipal land that is being used as a park is put up for sale," Thomas said. "While it’s a state park, it really functions as a neighborhood park for those who use it. I think what happens when we plan for large developments is that we don’t do enough to plan for parks with the density increase that’s coming."

The Sierra Club has been leading the charge against the bill. "We lose 40 acres but gain a bathroom," Arthur Feinstein, the Sierra Club’s local representative jokingly told the Guardian. "Now that’s a good deal!"

Observing that the organization’s position is "no net loss of acreage, no loss of biodiversity, no loss of wildlife corridors," Feinstein said, "There are a ton of alternatives to this plan and no reason to destroy 25 percent of the park or build a bridge and a road over Yosemite Slough."

With Arc’s studies showing that the bridge, which will cost $100 million to construct, only shaves two minutes off travel time, Feinstein added: "This is a road to nowhere. It’ll cost $50 million a minute."

He also said that allowing a company to buy state parkland "sets a terrible precedent… Then every state park is at risk from developers as the state’s budget woes grow. I hope Sen. Mark Leno sees this."

"No one would ever think put housing on Crissy Field," Feinstein continued. "But in the Bayview, the attitude is, why not? That whole mentality has made the area into an environmental justice community. Even when it’s given something, it comes in a costly way to the community, but a cheap way for the developers."

Arnold isn’t tough, he’s a coward

I’ve had it with Gov. Arnold Schwarzenegger’s action hero bullshit, wherein he masks his cowardly failures with a tough-talking veneer. The latest example is his campaign’s (yes, the termed out governor’s Join Arnold campaign team is still quite active) latest missive on California’s $24 billion budget deficit deadlock titled “Tough Times, Tough Choices.”

“To close California’s budget gap, the Governor has proposed deep cuts to education, public safety, and health and human services. He has also made clear his commitment to making government more efficient and to finding innovative ways to stretch taxpayer dollars. Tough choices must be made to get the state through this crisis, but if these tough choices are not made, the state will again be on the brink of insolvency,” they write.

Ending public health programs, robbing schools, closing parks, letting infrastructure deteriorate, and weakening the state’s ability to keep citizens safe isn’t tough. It’s the act of a coward, a bully beating up on the weak to appear strong while cowering before the actual tough guys. Taking on his political base and advocating higher taxes on millionaires – which this state desperately needs to do – that would be tough.

Eliminating dissent

For years, the Hunters Point Shipyard Restoration Advisory Board has served as the Bayview-Hunters Point community’s main voice in the U.S. Navy’s environmental cleanup plans for the toxic former naval station. But the committee is suddenly being disbanded just as the cleanup enters a crucial phase.

Used for shipbuilding and submarine maintenance and repair, and the decontamination, storage, and disposal of radioactive and atomic weapons testing materials, the shipyard was added to the Superfund national toxic site cleanup list in 1989. But it is also at the heart of where Mayor Gavin Newsom has partnered with Lennar Corp. on the city’s biggest development proposal, involving 10,500 homes and a new stadium for the 49ers.

As the Navy prepares to release a series of important studies and reports concerning the cleanup of the dirtiest parcels on the former shipyard, community members were outraged by the Navy’s announcement in late May that it is preparing to dissolve the RAB in the next 30 days.

In July the Navy will release draft feasibility studies for the cleanup of Parcel E, along with a final remedial investigation/feasibility study for Parcel E2, the dirtiest parcel on the base, and a radiological data-gathering investigation in the sediment surrounding Parcel F, which is the underwater portion of the base.

Some insiders say the announcement was not unexpected, given an escautf8g series of confrontational RAB meetings with the Navy over the last two years. But they fear the community will lose its ability to give the Navy direct, timely, and meaningful feedback, even if many believe the Navy wasn’t listening.

"The Navy fully supports the need for open, meaningful dialogue with the diverse Bayview-Hunters Point community regarding our environmental cleanup actions and decisions. However, the RAB is not fulfilling this objective," the Navy’s Laura Duchnak wrote in a May 22 letter to the RAB.

In her letter, Duchnak said the RAB meetings no longer provide community input on the Navy’s environmental cleanup program, that their atmosphere is not productive to effective public discourse, and that Navy attempts to improve the process have failed. "The revised community involvement program may include community environmental forums, including using Internet-based technologies to more easily reach a diverse audience, expanded monthly progress reports and fact sheets, and hosting technical discussions and tours of cleanup sites for interested community members," Duchnak wrote.

Duchnak’s announcement followed a tense January meeting in which RAB members reacted with horror when the Navy announced it was moving forward with controversial plans to cap radiologically-affected areas on the shipyard’s Parcel B instead of digging and hauling them, which the community preferred (see "Nuclear Fallout," 07/16/08).

Led by RAB co-chair Leon Muhammad, who teaches at the Nation of Islam’s Center for Self Improvement, which has been repeatedly dusted by unmonitored asbestos (see "The corporation that ate San Francisco," 03/17/07), and joined by newly sworn-in members Archbishop King, Marie Harrison, and Daniel Landry, the board voted to seek a civil grand jury investigation into whether local truckers are getting their fair share of the Navy’s shipyard contracts.

Members then voted to remove the city’s public health representative Amy Brownell from the RAB, and to call for the stoppage of all work on the yard until the Department of Defense, the Navy, and the city can prove, as Muhammad said, "where the ongoing dust exceedences are coming from."

The final straw, insiders say, occurred in February when members voted to remove the Navy’s RAB co-chair Keith Forman from the advisory board. Eric Smith, who was sworn onto the RAB in January but did not vote to remove Brownell and Forman, said the Navy’s dissolution response wasn’t surprising.

"The dissolution of RAB is not a good thing in terms of what it is supposed to do. But it was also doing things that were dysfunctional," Smith said. "The bitter irony is that the folks who caused the trouble were trying to get the Navy to sit up and take notice."

Smith said there is frustration with the Navy’s communication style, which the community feels is patronizing. "But the RAB was naïve to think the Navy would allow a forum over which it has unilateral authority to become a platform for attacks," Smith said.

RAB member Kristine Enea, who missed the RAB’s last two meetings, confirmed that the atmosphere got increasingly confrontational but added that the Navy ignored suggestions her calls for wider community involvement.

"It’s ironic that the Navy had decided to respond to criticisms, which include the charge that it is a poor communicator, by cutting off communications with the community," said Enea, who works at the India Basin Neighborhood Association. "Dissolving the RAB is a drastic step. There is so much going on, and so much that we need to know."

But Enea hopes IBNA can help fill that void, noting that the association has applied for a US Environmental Protection Agency technical assistant grant to review shipyard clean-up documents, provide fact sheets, and host community meetings.

The Sierra Club’s Arthur Feinstein said that his group’s main concern around the dissolution is that Parcel E2, which contains an industrial and radiologically-impacted dump that burned for six months in 2000, and Parcel F are both coming up for analysis.

"These are some of the most significantly contaminated areas on the shipyard, so the timing is terrible," Feinstein told the Guardian, observing that some RAB members did not appear to be looking for solutions and were so aggressive they destroyed meetings.

"Unfortunately there weren’t enough forceful people to say ‘shut up and sit down,’" Feinstein said. "But without a RAB, there will be no public forum where folks are able to get and read materials ahead of the meeting, and then ask and submit questions."

Harrison, a member of the environmental justice group Green Action, believes the Navy’s intent is that there be no meaningful interaction with the community. "When you don’t toe the line and play like good little children, the Navy shuts you down," said Harrison, whose group, along with the Nation of Islam and the Caravan for Justice, are planning a June 30 demonstration at the shipyard to protest the move.

In another point of controversy, Sen. Mark Leno has legislation that seeks to trade 25 percent of Candlestick Point State Recreation Area, the only major piece of open space in the Bayview, for small strips on the shipyard so Lennar can build condos on the parkland.

Noting that Sen. Leland Yee and Assembly Members Tom Ammiano and Fiona Ma oppose the parks-for-condos plan (see "Going Nuclear," April 29), Harrison said, "What possessed anyone to believe that we’d say, okay, take the only open space in the Bayview, and in exchange we’ll accept contaminated land scattered around on the shipyard?"

Environmental advocates believe the Sierra Club intends to fight Leno’s legislation with a challenge under the California Environmental Quality Act, but Leno told the Guardian that he is "continuing to work and meet with the lobbyists for the Sierra Club here in Sacramento to see if there are any additional amendments we can take that would get them to a neutral position on the bill.

"I think there is a good possibility we can get there," Leno said.

In February, Arc Ecology released a 133-report titled "Alternatives for study" that recommended the removal of the Parcel E2 landfill and explored changes in land use arrangements in the current redevelopment proposal to avoid environmental impacts (see "Concrete Plans," Feb. 4). Unfortunately, they were largely ignored by the Mayor’s Office of Economic and Workforce Development, which is working with Lennar on the public-private development deal.

Arc Ecology executive director Saul Bloom remains undaunted, recalling how 87 percent of voters citywide supported Proposition P, an advisory measure he wrote and that then-Sups. Ammiano, Leno, Michael Yaki, and the late Sue Bierman placed on the ballot in 1989 to establish community acceptance criteria for the shipyard, under federal toxic cleanup guidelines.

"The Navy had offered their opinion that voters in San Francisco, and especially in the Bayview, would accept a nonresidential industrial level cleanup for the shipyard because they were primarily interested in jobs," Bloom recalled. "We said that this was a mischaracterization and we’d go ahead and prove them wrong."

He believes the current struggle with the Navy over the RAB, and with the city and Lennar over Arc’s alternatives, are "emblematic of the problem facing the Bayview with regard to accessing good information and being told the straight story on health and development issues."

The budget battle of the decade will erupt at City Hall over the next few hours, with firefighters, cops, and representatives of Mayor Gavin Newsom rallying out front at 1 p.m. and the providers and users of other city services – those slashed by Newsom, from public health to parks to social services – rallying with progressive supervisors in the same spot at 12:30 p.m.
Newsom spokesperson Nate Ballard denied accusations of improper coordination between Newsom and firefighters, who are represented by Eric Jaye, who is also running Newsom gubernatorial campaign. “There is an ethical wall between the Mayor and Eric Jaye on these issues, ” Ballard said. “[Newsom] agrees with the firefighters, but he is not involved with planning the rally. Maybe he’ll stop by.”
Expect fireworks and angry accusations being traded before both sides file into Board Chambers at 2 p.m. as supervisors consider an interim budget that shifts $82 million in Newsom cuts over to the public safety departments that actually got small budget increases despite the $438 million deficit.
Newsom did finally follow through on his seven-month-old pledge to work with supervisors yesterday, meeting with Board President David Chiu and Budget Committee Chair John Avalos, but they failed to resolve the impasse. As Chiu told us, “We didn’t hear anything from the mayor that would change where we were last week.”
In other words: Game on!

Will the Assembly repeal the corporate tax breaks?

I talked to Assemblymember Tom Ammiano today, and he’s upbeat about the role his house may play in the budget process. He thinks the governor’s threat to shut down the state is just “scare tactics to make the Legislature look bad” and that the Assembly isn’t prepared to accept a “cuts only” budget. “We’re not going to roll over,” he said.

Among other things, he said, the $2.5 billion in tax giveaways to big corporations cpuld be repealed with a simply majority. So the Democratic leadership ought to be making that a priority, and talking it up in the media — would people rather see their state parks close and teachers be fired — or see a tiny number of giant businesses get more tax breaks?

Calitics points out that the CalTaxReform folks have identified $10 billion in new revenue measure that all appear to have majority support in the polls.

So let’s hope the top Democrats call Arnold’s bluff, and offer some real alterntives.
