SUPERVISOR, DISTRICT 2


JANET REILLY


Frankly, we were a little surprised by the Janet Reilly who came in to give us her pitch as a District 2 supervisorial candidate. The last time we met with her, she was a strong progressive running for state Assembly as an advocate of single-payer health care. She was challenging Fiona Ma from the left, and easily won our endorsement.


Now she’s become a fiscal conservative — somewhat more in synch with her district, perhaps, but not an encouraging sign. Reilly seems to realize that there’s a $500 million budget deficit looming, but she won’t support any of the tax measures on the ballot. She’s against the hotel tax. She’s against the real estate transfer tax on high-end properties. She’s against the local car tax. She opposed Sup. David Chiu’s business tax plan that would have shifted the burden from small to larger businesses (even though it was clear from our interview that she didn’t understand it).


She talked about merging some of the nonprofits that get city money, about consolidating departments, and better management — solutions that might stem a tiny fraction of the red ink. But she wouldn’t even admit that the limited tax burden on the very rich was part of San Francisco’s budget problem.


Her main proposal for creating jobs is more tax credits for biotech, life sciences, and digital media and more public-private partnerships.


It’s too bad, because Reilly’s smart, and she’s far, far better than Mark Farrell, the candidate that the current incumbent, Michela Alioto-Pier, is backing. We wish she’d be realistic about the fiscal nightmare she would inherit as a supervisor.


On the positive side, she’s a strong supporter of public power and she has good connections to the progressive community. Unlike Alioto-Pier, she’d be accessible, open-minded, and willing to work with the progressive majority on the board. That would be a dramatic change, so we’ll give her the nod.


We were also impressed with Abraham Simmons, a federal prosecutor who has spent time researching city finance on the Civil Grand Jury. But he supports sit-lie, Prop. B and Prop. S, and opposes most new tax proposals and needs more political seasoning.


 


DISTRICT 4


NO ENDORSEMENT


We’ve always wanted to like Carmen Chu. She’s friendly, personable, intelligent, and well-spoken. But on the issues, she’s just awful. Indeed, we can’t think of a single significant vote on which she’s been anything but a call-up loyalist for Mayor Newsom. She even opposed the public power measure, Prop. H, that had the support of just about everyone in town except hardcore PG&E allies.


She’s running unopposed, and will be reelected. But we can’t endorse her.

A year ago, this race was artist and activist Debra Walker’s to lose. Most of the progressive community was united behind her candidacy; she’d been working on district issues for a couple of decades, fighting the loft developers during the dot-com boom years and serving on the Building Inspection Commission. Then School Board member Jane Kim decided to enter the race, leaving the left divided, splitting resources that might have gone to other critical district races — and potentially helping to put the most pro-business downtown candidate, Theresa Sparks, in a better position to win.


Now we’ve got something of a mess — a fragmented and sometimes needlessly divisive progressive base in a district that’s key to holding progressive control of the board. And while neither of the two top progressive candidates is actively pursuing a credible ranked-choice voting strategy (Kim has, unbelievably, endorsed James Keys instead of Walker, and Walker has declined to endorse anyone else), we’re setting aside our concern over Kim’s ill-advised move and suggesting a strategy that is most likely to keep the seat Chris Daly has held for the past 10 years from falling to downtown control.


Walker is far and away our first choice. She understands land use and housing — the clear central issues in the district — and has well thought-out positions and proposals. She says that the current system of inclusionary housing — pressing market-rate developers to include a few units of below-market-rate housing with their high-end condos — simply doesn’t work. She supports an immediate affordable housing bond act and a long-term real estate transfer tax high enough to fund a steady supply of housing for the city’s workforce. She told us the city ought to be looking at planning issues from the perspective of what San Francisco needs, not what developers want to build. She’s in favor of progressive taxes and a push for local hiring. We’re happy to give her our first-place ranking.


Jane Kim has been a great SF School Board member and has always been part of the progressive community. But she only moved into District 6 a year and a half ago — about when she started talking about running for supervisor (and she told us in her endorsement interview that “D6 is a district you can run in without having lived there a long time.”) She still hasn’t been able to explain why she parachuted in to challenge an experienced progressive leader she has no substantive policy disagreements with.


That said, on the issues, Kim is consistently good. She is in favor of indexing affordable housing to market-rate housing and halting new condo development if the mix gets out of line. She’s for an affordable housing bond. She supports all the tax measures on this ballot. She’s a little softer on congestion pricing and extending parking-meter hours, but she’s open to the ideas. She supports police foot patrols not just as a law-enforcement strategy, but to encourage small businesses. She’d be a fine vote on the board. And while we’re sympathetic to the Walker supporters who would prefer that we not give Kim the credibility and exposure of an endorsement, the reality is that she’s one of two leading progressives and would be better on the board than the remaining candidates.


Hyde, a dynamic young drag queen performer, isn’t going to win. But he’s offered some great ideas and injected some fun and energy into the race. Hyde talks about creating safe injection sites for IV drug users to reduce the risk of overdoses and the spread of disease. He points out that a lot of young people age out of the foster-care system and wind up on the streets, and he’s for continuum housing that would let these young people transition to jobs or higher education. He talks about starting a co-op grocery in the Tenderloin. He proposes bus-only lanes throughout the district and wants to charge large vehicles a fee to come into the city. He’s a big advocate of nightlife and the arts. He lacks experience and needs more political seasoning, but we’re giving him the third-place nod to encourage his future involvement.


Progressives are concerned about Theresa Sparks, a transgender activist and former business executive who now runs the city’s Human Rights Commission. She did a (mostly) good job on the Police Commission. She’s experienced in city government and has good financial sense. But she’s just too conservative for what remains a very progressive district. Sparks isn’t a big fan of seeking new revenue for the city telling us that “I disagree that we’ve made all the cuts that we can” — even after four years of brutal, bloody, all-cuts budgets. She doesn’t support the hotel tax and said she couldn’t support Sup. David Chiu’s progressive business tax because it would lead to “replacing private sector jobs with public sector jobs” — even though the city’s own economic analysis shows that’s just not true. She supports Newsom’s sit-lie law.


Sparks is the candidate of the mayor and downtown, and would substantially shift the balance of power on the board. She’s also going to have huge amounts of money behind her. It’s important she be defeated.


Jim Meko, a longtime neighborhood and community activist, has good credentials and some solid ideas. He was a key player in the western SoMa planning project and helped come up with a truly progressive land-use program for the neighborhood. But he supports Prop. B and is awfully cranky about local bars and nightlife.


James Keys, who has the support of Sup. Chris Daly and was an intern in Daly’s office, has some intriguing (if not terribly practical) ideas, like combining the Sheriff’s Department and the Police Department and making Muni free). But in his interview, he demonstrated a lack of understanding of the issues facing the district and the city.


So we’re going with a ranked-choice strategy: Walker first, Kim second, Hyde third. And we hope Kim’s supporters ignore their candidate’s endorsement of Keys, put Walker as their second choice, and ensure that they don’t help elect Sparks.


 


DISTRICT 8


RAFAEL MANDELMAN


This is by far the clearest and most obvious choice on the local ballot. And it’s a critical one, a chance for progressives to reclaim the seat that once belonged to Harvey Milk and Harry Britt.


Mandelman, a former president of the Milk Club, is running as more than a queer candidate. He’s a supporter of tenants rights, immigrants’ rights, and economic and social justice. He also told us he believes “local government matters” — and that there are a lot of problems San Francisco can (and has to) solve on its own, without simply ducking and blaming Sacramento and Washington.


Mandelman argues that the public sector has been starved for years and needs more money. He agrees that there’s still a fair amount of bloat in the city budget — particularly management positions — but that even after cleaning out the waste, the city will still be far short of the money it needs to continue providing pubic services. He’s calling for a top-to-bottom review of how the city gets revenue, with the idea of creating a more progressive tax structure.


He’s an opponent of sit-lie and a supporter of the sanctuary city ordinance. He supports tenants rights and eviction protection. He’s had considerable experience (as a member of the Building Inspection Commission and Board of Appeals and as a lawyer who advises local government agencies) and would make an excellent supervisor.


Neither of the other two contenders make our endorsement cut. Rebecca Prozan is a deputy city attorney who told us she would be able to bring the warring factions on the board together. She has some interesting ideas — she’d like to see the city take over foreclosed properties and turn them into housing for teachers, cops, and firefighters — and she’s opposed to sit-lie. But she’s weak on tenant issues (she told us there’s nothing anyone can do to stop the conversion of rental housing into tenancies-in-common), doesn’t seem to grasp the need for substantial new revenues to prevent service cuts, and doesn’t support splitting the appointments to key commissions between the mayor and the supervisors.


Scott Wiener, a deputy city attorney, is a personable guy who always takes our phone calls and is honest and responsive. He’s done a lot of good work in the district. But he’s on the wrong side of many issues, and on some things would be to the right of the incumbent, Sup. Bevan Dufty.


He doesn’t support public power (which Dufty does). He says that a lot of the city’s budget problems can’t be solved until the state gets its own house in order (“we can’t tax our way out of this”) and favors a budget balanced largely by further cuts. In direct contrast to Mandelman, Wiener said San Franciscans “need to lower our expectations for government.” He wants broad-based reductions in almost all city agencies except Muni, “core” public health services, and public safety. He doesn’t support any further restrictions on condo conversions or TICs. And he has the support of the Small Property Owners Association — perhaps the most virulently anti-tenant and anti-rent control group in town.


This district once gave rise to queer political leaders who saw themselves and their struggles as part of a larger progressive movement. That’s drifted away of late — and with Mandelman, there’s a chance to bring it back.


 


DISTRICT 10

3. CHRIS JACKSON


District 10 is the epicenter of new development in San Francisco, the place where city planners want to site as many as 40,000 new housing units, most of them high-end condos, at a cost of thousands of blue-collar jobs. The developers are salivating at the land-rush opportunities here — and the next supervisor not only needs to be an expert in land-use and development politics, but someone with the background and experience to thwart the bad ideas and direct and encourage the good ones.


There’s no shortage of candidates — 22 people are on the ballot, and at least half a dozen are serious contenders. Two — Steve Moss and Lynette Sweet — are very bad news. And one of the key priorities for progressives is defeating the big-money effort that downtown, the police, and the forces behind the Van Ness Avenue megahospital proposal are dumping into the district to elect Moss.


Our first choice is Tony Kelly, who operates Thick Description Theater and who for more than a decade has been directly involved in all the major neighborhood issues. He has a deep understanding of what the district is facing: 4,100 of the 5,300 acres in D10 have been rezoned or put under the Redevelopment Agency in the past 10 years. Planners envision as many as 100,000 new residents in the next 10 years. And the fees paid by developers will not even begin to cover the cost of the infrastructure and services needed to handle that growth.


And Kelly has solutions: The public sector will have to play a huge role in affordable housing and infrastructure, and that money should come from higher development fees — and from places like the University of California, which has a huge operation in the district and pays no property taxes. Kelly wants to set up a trigger so that if goals for affordable housing aren’t met by a set date, the market-rate development stops. He supports the revenue measures on the ballot but thinks we should go further. He opposes the pension-reform measure, Prop. B, but notes that 75 percent of the city’s pension problems come from police, fire, and management employees. He wants the supervisors to take over the Redevelopment Agency. He’s calling for a major expansion of open space and parkland in the district. And he thinks the city should direct some of the $3 billion in short-term accounts (now all with the Bank of America) to local credit unions or new municipal bank that could invest in affordable housing and small business. He’s a perfect fit for the job.


DeWitt Lacy is a civil-rights lawyer and a relative newcomer to neighborhood politics. He speaks passionately about the need for D10 to get its fair share of the city’s services and about a commitment to working-class people.


Lacy is calling for an immediate pilot program with police foot patrols in the high-crime areas of the district. He’s for increasing the requirements for developers to build affordable housing and wants to cut the payroll tax for local businesses that hire district residents.


Lacy’s vision for the future includes development that has mixed-use commuter hubs with shopping and grocery stores as well as housing. He supports the tax measures on the ballot and would be willing to extend parking meter hours — but not parking fines, which he calls an undue burden on low-income people.


He’s an outspoken foe of sit-lie and of gang injunctions, and with his background handling police abuse lawsuits, he would have a clear understanding of how to approach better law-enforcement without intimidating the community. He lacks Kelly’s history, experience, and knowledge in neighborhood issues, but he’s eminently qualified and would make a fine supervisor.


Chris Jackson, who worked at the San Francisco Labor Council and serves on the Community College Board, is our third choice. While it’s a bit unfortunate that Jackson is running for higher office only two years after getting elected to the college board, he’s got a track record and good positions on the issues. He talks of making sure that blue-collar jobs don’t get pushed out by housing, and suggested that the shipyard be used for ship repair. He wants to see the city mandate that landlords rent to people with Section 8 housing vouchers. He supports the tax measures on the ballot, but also argues that the city has 60 percent more managers than it had in 2000 and wants to bring that number down. He thinks the supervisors should take over Redevelopment, which should become “just a financing agency for affordable housing.” He wants to relocate the stinky sewage treatment plant near Third Street and Evans Avenue onto one of the piers and use the area for a transit hub. He’s still relatively unseasoned, but he has a bright political future.


Eric Smith, a biodiesel activist, is an impressive candidate too. But while his environmental credentials are good, he lacks the breadth of knowledge that our top three choices offer. But we’re glad he’s in the race and hope he stays active in community politics.


Malia Cohen has raised a lot of money and (to our astonishment) was endorsed No. 2 by the Democratic Party, but she’s by no means a progressive, particularly on tenant issues — she told us that limiting condo conversions is an infringement of property rights. And she’s way too vague on other issues.


Moss is the candidate of the big developers and the landlords, and the Chamber of Commerce is dumping tens of thousands of dollars into getting him elected. He’s got some good environmental and energy ideas — he argues that all major new developments should have their own energy distribution systems — but on the major issues, he’s either on the wrong side or (more often) can’t seem to take a stand. He said he is “still mulling over” his stand on sit-lie. He supports Sanctuary City in theory, but not the actual measure Sup. David Campos was pushing to make the policy work. He’s not sure if he likes gang injunctions or not. He only moved back to the district when he decided to run for supervisor. He’s way too conservative for the district and would be terrible on the board.


Lynette Sweet, a BART Board member, has tax problems (and problems explaining them) and wouldn’t even come to our office for an endorsement interview. The last thing D10 needs is a supervisor who’s not accountable and unwilling to talk to constituents and the press.


So we’re going with Kelly, Lacy, and Jackson as the best hope to keep D10 from becoming a district represented by a downtown landlord candidate.


 


SAN FRANCISCO BOARD OF EDUCATION


MARGARET BRODKIN


KIM-SHREE MAUFAS


HYDRA MENDOZA


Three seats are up on the School Board, and three people will get elected. And it’s a contested race, and in situations like that, we always try to endorse a full slate.


This fall, it was, to put it mildly, a challenge.


It’s disturbing that we don’t have three strong progressive candidates with experience and qualifications to oversee the San Francisco Unified School District. But it seems to be increasingly difficult to find people who want to — and can afford to — devote the time to what’s really a 40-hour-a-week position that pays $500 a month. The part-time school board is an anachronism, a creature of a very different economic and social era. With the future of the next generation of San Franciscans at stake, it’s time to make the School Board a full-time job and pay the members a decent salary so that more parents and progressive education advocates can get involved in one of the most important political jobs in the city.


That said, we’ve chosen the best of the available candidates. It’s a mixed group, made up of people who don’t support each other and aren’t part of anyone’s slate. But on balance, they offer the best choices for the job.


This is not a time when the board needs radical change. Under Superintendent Carlos Garcia, the local public schools are making huge strides. Test scores are up, enrollment is increasing, and San Francisco is, by any rational measure, the best big-city public school district in California. We give considerable credit for that to the progressives on the board who got rid of the irascible, secretive, and hostile former Superintendent Arlene Ackerman and replaced her with Garcia. He’s brought stability and improvement to the district, and is implementing a long-term plan to bring all the schools up to the highest levels and go after the stubborn achievement gap.


Yet any superintendent and any public agency needs effective oversight. One of the problems with the district under Ackerman was the blind support she got from school board members who hired her; it was almost as if her allies on the board were unable to see the damage she was doing and unable to hold her accountable.


Our choices reflect the need for stability — and independence. We are under no illusions — none of our candidates are perfect. But as a group, we believe they can work to preserve what the district is doing right and improve on policies that aren’t working.


Kim-Shree Maufas has been a staunch progressive on the board. She got into a little trouble last year when the San Francisco Chronicle reported that she’d been using a school district credit card for personal expenses. That’s not a great move, but she never actually took public money since she paid back the district. Maufas said she thought she could use the card as long as she reimbursed the district for her own expenses; the rules are now clear and she’s had no problems since. We don’t consider this a significant enough failure in judgment to prevent her from continuing to do what she’s been doing: serving as an advocate on the board for low-income kids and teachers.


Maufas is a big supporter of restorative justice and is working for ways to reduce suspensions and expulsions. She wants to make sure advanced placement and honors classes are open to anyone who can handle the coursework. She supports the new school assignment process (as do all the major candidates), although she acknowledges that there are some potential problems. She told us she thinks the district should go back to the voters for a parcel tax to supplement existing funding for the schools.


Margaret Brodkin is a lightening rod. In fact, much of the discussion around this election seems to focus on Brodkin. Since she entered the race, she’s eclipsed all the other issues, and there’s been a nasty whisper campaign designed to keep her off the board.


We’ve had our issues with Brodkin. When she worked for Mayor Newsom, she was part of a project that brought private nonprofits into city recreation centers to provide services — at a time when unionized public employees of the Recreation and Parks Department were losing their jobs. It struck us as a clear privatization effort by the Newsom administration, and it raised a flag that’s going to become increasingly important in the school district: there’s a coming clash between people who think private nonprofits can provide more services to the schools and union leaders who fear that low-paid nonprofit workers will wind up doing jobs now performed by unionized district staff. And Brodkin’s role in the Newsom administration — and her background in the nonprofit world — is certainly ground for some concern.


But Brodkin is also by far the most qualified person to run for San Francisco school board in years, maybe decades. She’s a political legend in the city, the person who is most responsible for making issues of children and youth a centerpiece of the progressive agenda. In her years as director of Coleman Advocates for Children and Youth, she tirelessly worked to make sure children weren’t overlooked in the budget process and was one of the authors of the initiative that created the Children’s Fund. She’s run a nonprofit, run a city department, and is now working on education issues.


She’s a feisty person who can be brusque and isn’t always conciliatory — but those characteristics aren’t always bad. Sup. Chris Daly used his anger and passion to push for social justice on the Board of Supervisors and, despite some drawbacks, he’s been an effective public official.


And Brodkin is full of good ideas. She talks about framing what a 21st century education looks like, about creating community schools, about aligning after-school and summer programs with the academic curriculum. She wants the next school bond act to include a central kitchen, so local kids can get locally produced meals (the current lunch fare is shipped in frozen from out of state).


Brodkin needs to remember that there’s a difference between being a bare-knuckles advocate and a member of a functioning school board. But given her skills, experience, and lifetime in progressive causes, we’re willing to give her a chance.


We also struggled over endorsing Hydra Mendoza. She works for Mayor Newsom as an education advisor — and that’s an out-front conflict of interest. She’s a fan of Obama’s Education Secretary, Arne Duncan, whose policies are regressive and dangerous.


On the other hand, she cares deeply about kids and public education. She’s not a big supporter of charter schools (“I’ve yet to see a charter school that offers anything we can’t do ourselves,” she told us) and while she was on the wrong side of a lot of issues (like JROTC) early in her tenure, over the past two years she’s been a good School Board member.


There are several other candidates worth mentioning. Bill Barnes, an aide to Michela Alioto-Pier, is a good guy, a decent progressive — but has no experience in or direct connection to the public schools. Natasha Hoehn is in the education nonprofit world and speaks with all the jargon of the educrat, but her proposals and her stands on issues are vague. Emily Murase is a strong parent advocate with some good ideas, but she struck us as a bit too conservative (particularly on JROTC and charter schools.) Jamie Wolfe teaches at a private school but lacks any real constituency or experience in local politics and the education community.


So given a weak field with limited alternatives, we’re going with Maufas, Brodkin and Mendoza.


 


SAN FRANCISCO COMMUNITY COLLEGE BOARD


JOHN RIZZO


The San Francisco Community College District has been a mess for years, and it’s only now starting to get back on track. That’s the result of the election of a few progressive reformers — Milton Marks, Chris Jackson, and John Rizzo, who now have enough clout on the seven-member board to drag along a fourth vote when they need it.


But the litany of disasters they’ve had to clean up is almost endless. A chancellor (who other incumbent board members supported until the end) is now under indictment. Public money that was supposed to go to the district wound up in a political campaign. An out-of-control semiprivate college foundation has been hiding its finances from the public. The college shifted bond money earmarked for an arts center into a gigantic, expensive gym with a pool that the college can’t even pay to operate, so it’s leased out to a private high school across the street.


And the tragedy is that all three incumbents — two of whom should have stepped down years ago — are running unopposed.


With all the attention on the School Board and district elections, not one progressive — in fact, not one candidate of any sort — has stepped forward to challenge Anita Grier and Lawrence Wong. So they’ll get another term, and the reformers will have to continue to struggle.


We’re endorsing only Rizzo, a Sierra Club staffer who has been in the lead in the reform bloc. He needs to end up as the top vote-getter, which would put him in position to be the board president. Rizzo has worked to get the district’s finances and foundation under control and he richly deserves reelection.


 


BART BOARD OF DIRECTORS, DISTRICT 8


BERT HILL


It’s about time somebody mounted a serious challenge to James Fang, the only elected Republican in San Francisco and a member of one of the most dysfunctional public agencies in California. The BART Board is a mess, spending a fortune on lines that are hardly ever used and unable to work effectively with other transit agencies or control a police force that has a history of brutality and senseless killing.


Fang supports the suburban extensions and Oakland Airport connector, which make no fiscal or transportation sense. He’s ignored problems with the BART Police for 20 years. It’s time for him to leave office.


Bert Hill is a strong challenger. A professional cost-management executive, he understands that BART is operating on an old paradigm of carrying people from the suburbs into the city. “Before we go on building any more extensions,” he told us, “we should take care of San Francisco.” He wants the agency to work closely with Muni and agrees there’s a need for a BART sunshine policy to make the notoriously secretive agency more open to public scrutiny. We strongly endorse him.


 


ASSESSOR-RECORDER


PHIL TING


San Francisco needs an aggressive assessor who looks for every last penny that big corporations are trying to duck paying — but this is also a job that presents an opportunity for challenging the current property tax laws. Phil Ting’s doing pretty well with the first part — and unlike past assessors, is actually stepping up to the plate on the second. He’s been pushing a statewide coalition to reform Prop. 13 — and while it’s an uphill battle, it’s good to see a tax assessor taking it on. Ting has little opposition and will be reelected easily.


 


PUBLIC DEFENDER


JEFF ADACHI


Adachi’s done a great job of running the office that represents indigent criminal defendants. He’s been outspoken on criminal justice issues. Until this year, he was often mentioned as a potential progressive candidate for mayor.


That’s over now. Because Adachi decided (for reasons we still can’t comprehend) to join the national attack on public employees and put Prop. B on the ballot, he’s lost any hope of getting support for higher office from the left. And since the moderate and conservative forces will never be comfortable with a public defender moving up in the political world, Adachi’s not going anywhere anytime soon.


Which is fine. He’s doing well at his day job. We wish he’d stuck to it and not taken on a divisive, expensive, and ill-conceived crusade to cut health care benefits for city employees.


 


SAN FRANCISCO SUPERIOR COURT


SEAT 15


MICHAEL NAVA


To hear some of the brahmins of the local bench and bar tell it, the stakes in this election are immense — the independence of the judiciary hangs in the balance. If a sitting judge who is considered eminently qualified for the job and has committed no ethical or legal breaches can be challenged by an outsider who is seeking more diversity on the bench, it will open the floodgates to partisan hacks taking on good judges — and force judicial candidates to raise money from lawyers and special interests, thus undermining the credibility of the judiciary.


We are well aware of the problems of judicial elections around the country. In some states, big corporations that want to influence judges raise and spend vast sums on trial and appellate court races — and typically get their way. In Iowa, three judges who were willing to stand on principle and Constitutional law and declare same-sex marriage legal are facing what amounts to a well-funded recall effort. California is not immune — in more conservative counties, liberal judges face getting knocked off the bench by law-and-order types.


It’s a serious issue. It’s worth a series of hearings in the state Legislature, and it might be worth Constitutional change. Maybe trial-court elections should be eliminated. Maybe all judicial elections should have public campaign financing. But right now, it’s an elected office — at least in theory.


In practice, the vast majority of the judicial slots in California are filled by appointment. Judges serve for four-year terms but tend to retire or step down in midterm, allowing the governor to fill the vacancy. Unless someone files specifically to challenge an incumbent, typically appointed judge, that race never even appears on the ballot.


The electoral process is messy and political, and raising money is unseemly for a judicial officer. But the appointment process is hardly pure, either — and governors in California have, over the past 30 years, appointed the vast majority of the judges from the ranks of big corporate law firms and district attorney’s offices.


There are, of course, exceptions, and Gov. Arnold Schwarzenegger has been better than his predecessor, Democrat Gray Davis. But overall, public interest lawyers, public defenders, and people with small community practices (and, of course, people who have no political strings to pull in Sacramento) have been frustrated. And it’s no surprise that some have sought to run against incumbents.


That’s what’s happening here. Michael Nava, a gay Latino who has been working as a research attorney for California Supreme Court Justice Carlos Moreno, was going to run for a rare open seat this year, but the field quickly got crowded. So Nava challenged Richard Ulmer, a corporate lawyer appointed by Schwarzenegger who has been on the bench a little more than a year.


We will stipulate, as the lawyers say: Ulmer has done nothing wrong. From all accounts, he’s a fine judge (and before taking the bench, he did some stellar pro bono work fighting for reforms in the juvenile detention system). So there are two questions here: Should Nava have even filed to run against Ulmer? And since he did, who is the better candidate?


It’s important to understand this isn’t a case of special interests and that big money wanting to oust a judge because of his politics or rulings. Nava isn’t backed by any wealthy interest. There’s no clear parallel to the situations in other areas and other states where the judiciary is being compromised by electoral politics. Nava had every right to run — and has mounted an honest campaign that discusses the need for diversity on the bench.


Ulmer’s supporters note — correctly — that the San Francisco courts have more ethnic and gender diversity than any county in the state. And we’re not going to try to come to a conclusion here about how much diversity is enough.


But we will say that life experience matters, and judges bring to the bench what they’ve lived. Nava, who is the grandson of Mexican immigrants and the first person in his family to go to college, may have a different perspective on how low-income people of color are treated in the courts than a former Republican who spent his professional career in big law firms.


We were impressed by Nava’s background and knowledge — and by his interest in opening up the courts. He supports cameras in the courtrooms and allowing reporters to record court proceedings. He told us the meetings judges hold on court administration should be open to the public.


We’re willing to discuss whether judicial elections make sense. Meanwhile, judges who don’t like the idea of challenges should encourage their colleagues not to retire in midterm. If all the judges left at the end of a four-year term, there would be plenty of open seats and fewer challenges. But for now, there’s nothing in this particular election that makes us fear for the independence of the courts. Vote for Nava.

The test of the Tenderloin

This is a story about love and money. Or a story about love, money, and location. — Rebecca Solnit, Hollow City (Verso 2000)

It’s a sunny day in the most maligned neighborhood in San Francisco. I’m walking down a busy sidewalk with an excited Randy Shaw, long-time housing advocate. He’s giving me a tour of his Tenderloin.

“There’s history everywhere you look here,” he notes as we rush about the dingy blocks of one of the city’s most densely populated, economically bereft communities. In a half-untucked navy button-down and square-frame glasses, Shaw reels off evidence of this legacy faster than I can write it down and still maintain our walking pace.

To our left, Hyde Street Studios, where the Grateful Dead recorded its 1970 album American Beauty. Across the street, a ramshackle building that once housed Guido Caccienti’s Black Hawk nightclub, where the sounds of jam-fests by the likes of Billie Holiday and John Coltrane would echo out onto the streets during its heyday in the 1950s. Throughout its history, the Tenderloin has been renowned for its nightlife: music, theater, sex work — and the social space that occurs between them.

Shaw came to the Tenderloin 30 years ago as a young law student and founded and built the Tenderloin Housing Clinic, a nonprofit agency that is now one of the largest property owners in the neighborhood and employs more than 250 full-time workers. Shaw has spent the last few decades fighting to improve conditions in the single-room occupancy hotels, or SROs, once notorious for malfunctioning heating systems and mail rooms that would dump the letters for their hundreds of low-income residents into a pile on the floor rather than fit them into personal lock boxes (which now line the walls of THC’s lobbies).

But that activism isn’t the reason for this tour. No, today Shaw is showing me why tourism can work in the Tenderloin. The heavy iron gate of an SRO is quickly buzzed open as the doorman recognizes him. Inside, working-class seniors mill about aided by walkers — this particular property is an old folks’ home — but over our heads, affixed to a majestically high ceiling, looms a triple-tiered glass and metal chandelier, evidence of the area’s architecturally important past.

“When I show people this,” Shaw smiles at my amazement at this bling in a nonprofit apartment building, “they’re amazed at the quality of the housing.” Further down the road, we peep in at a vividly Moorish geometric vaulted ceiling and a lobby that once housed a boxing gym where Miles Davis and Muhammad Ali liked to spar. Both are now home to the inner city’s poorest residents.

Of course, it’s not just tours that we’re talking when it comes to Shaw’s plans for the future. Shaw has acquired a 6,400-square-foot storefront in the Cadillac Hotel on the corner of Eddy and Leavenworth streets, where he plans to open the Uptown Tenderloin Museum in 2012. He says it will showcase the hood’s historical legacy as well as house a nighttime music venue in the basement. The increased foot traffic, he says, will do good things for public safety (a problem that has been identified as a high priority by the resident-run Tenderloin Neighborhood Association) and bring business to the neighborhood’s impressive collection of small ethnic restaurants.

An increased focus on the Tenderloin’s heritage and public image, Shaw says, will translate to more jobs and a better quality of life for the people who live here. “My goal is to have this be the first area in an American city where low income people have a high quality of life,” he says.

If Shaw is correct, it will indeed be a first. Many cities have attempted to transform low income areas with arts districts — and the end result has typically been the displacement of the poorer residents. Coalition on Homelessness director Jennifer Friedenbach described the process: “Gentrification follows a very specific path. First come police sweeps, then the arts, then the displacement. That’s the path that we’re seeing. Hopefully we’ll be able to avoid the displacement part,” she says.

It’d be great if the Tenderloin took the road less traveled — but will it?

Shaw’s best-case scenario seems unlikely, according to Chester Hartman, a renowned urban planning scholar and author of the numerous studies of San Francisco history and the activist handbook Displacement: How to Fight It (National Housing Law Project 1982). Hartman doubts the Tenderloin will remain a housing option for the city’s poor, given its central location and market trends. “The question is, what proportion will move and what will stay?” he said in a phone interview.

Earlier this summer, the National Endowment of the Arts awarded the SF Arts Commission $250,000 toward an arts-based “revitalization of the mid-Market neighborhood.” The area, which is adjacent to the Tenderloin, is considered by many to be the more outwardly visible face of the TL. In truth, the two neighborhoods share many of the same issues and public characteristics, including high density living and prominent issues with drugs.

Amy Cohen, Mayor Gavin Newsom’s director of neighborhood business development, said the Newsom administration is using the money “to implement arts programming that would have an immediate impact on the street. These activities would then build momentum for the longer-term projects.” At this point, plans for that “immediate impact” have started with the installation of lights on Market Street between Sixth and Eighth streets. Two other projects are also in effect: a city-sponsored weekly arts market on United Nations Plaza and an al fresco public concert series.

It’s hard to distinguish these moves from a general trend toward rebranding the image of the Tenderloin. These streets have already seen Newsom announce a historic preservation initiative that put $15,000 worth of commemorative plaques on buildings; it was also announced they would be added to the National Register of Historic Places, a move that allows property owners deep tax cuts for building renovations.

Cohen said her office has spent time trying to attract a supermarket (something the neighborhood, although flush with corner stores, currently lacks), but efforts seem to be faltering. “Grocery store operators and other retailers perceive that the area is unsafe and have expressed concerns about the safety of their employees and customers,” Cohen said. “The arts strategy makes sense because it builds on the assets that are there. Cultivating the performing and visual arts uses that are already succeeding will ultimately enhance the neighborhood’s ability to attract restaurants, retail, and needed services like grocery stores.”

These days, many of the small businesses in the area have window signs hyping “Uptown Tenderloin: Walk, Dine, Enjoy” over graphics of jazzy, people-free high-rises. Looking skyward, one observes the recent deployment of tidy street banners funded by the North of Market/Tenderloin Community Benefit District that pay homage to the number of untouched historic buildings in the neighborhood. The banners read “409 historic buildings in 33 blocks. Yeah, we’re proud.”

Figuring out who benefits from these new bells and whistles can seem baffling at times. Even the museum plan, which Shaw says will draw inspiration in part from New York’s Tenement Museum, has drawn criticism. A July San Francisco Magazine blog post was subtitled “An indecent proposal that puzzled even the San Francisco Visitors Bureau” and likened Shaw’s attempts to the “reality tourism movement” that takes travelers through gang zones in L.A. and poverty-stricken townships in South Africa.

This seems to be a misconstruction of what he’s attempting. “You know what no one ever calls out? The Mission mural tours, the Chinatown tours,” Shaw says.

And Shaw scoffs when I bring up that PR bane of the urban renewer: gentrification. He takes me through a brief rundown of the strict zoning laws in the Tenderloin, adding that many people don’t believe that poor people have the right to live in a high-quality neighborhood: “I haven’t been down here for 30 years to create a neighborhood no one wants to live in.”

Indeed, thanks to the efforts of Shaw and others, it would be hard for even the most determined developers to get rid of the SRO housing in the Tenderloin.

In the 1980s, community activists struggled to change the zoning designation of the neighborhood, which lacked even a name on many city maps. The area was zoned for high-rise buildings and was being encroached on by the more expensive building projects of tourist-filled Union Square, Civic Center, and the wealthier Nob Hill neighborhood. Their success came in the form of 1990s Residential Hotel Anti-Conversion Ordinance, which placed strict limits on landlords flipping their SROs into more expensive housing.

Hartman remains unconvinced of the efficacy of the protective measures activists have won in years past; indeed, even SRO rental prices have soared. According to the Central City SRO Collaborative, in the decade after the Anti-Conversion Ordinance, rental prices increased by 150 percent, not only pricing residents out of the Tenderloin but out of the city. “Where do they move?” Hartman asked. “It’s probably the last bastion of low-income housing in the city. That changes the class composition of the city.”

“The neighborhood has been changing slowly but steadily,” says District Six Sup. Chris Daly when reached by e-mail for comment on the Tenderloin’s future. He writes that rents in the neighborhood have been consistently rising and that several condo development proposals have crossed his desk. Daly has been involved in negotiating “community benefits” and quotas for low income housing in past mid-Market housing projects, but has been disappointed by subsequent affordable housing levels in projects like Trinity Plaza on the corner of Sixth and Market streets. In terms of the Tenderloin, he said, “it is untrue to say that the neighborhood is immune from gentrifying forces. It is shielded, but not immune.”

But some see the influx of art-based attention to the area as a possible boon to residents. Debra Walker, a San Franciscan artist who is running for the District 6 supervisor post, said she believes arts can be used “organically to resolve some of the chronic problems in the Tenderloin, street safety being the primary one in my mind.”

Though most of her fellow candidates expressed similar views when contacted for this story, western SoMa neighborhood activist Jim Meko said he thinks artists in the area are being used to line the pockets of the real estate industry. “The idea of creating an arts district is an amenity that the real estate dealers want to see because it makes the neighborhood less scary for their upper class audience” he says.

The area clearly has a rich legacy of nightlife, arts, and theater. The Warfield is here, as is American Conservatory Theater, the Orpheum, and the Golden Gate. So is the unofficial center of SF’s “off-off Broadway district,” which includes Cutting Ball Theater and Exit Theater. The Exit has been located in the TL since its first performance in 1983, held in the lobby of the Cadillac Hotel, and sponsors the neighborhood’s yearly Fringe Festival. There are art galleries and soup kitchens, youth and age, and more shouted greetings on the streets than you’ll hear anywhere else in the city.

No one is more aware of this diversity of character than Machiko Saito, program director of Roaddawgz, a TL creative drop-in center and resource referral service for homeless youth. I met Saito in the Roaddawgz studio, which occupies a basement below Hospitality House, a homeless community center that also houses a drop-in self-help center, an employment program, men’s shelter and art studio for adults in transition.

Despite its being empty in the morning before the open hours that bring waves of youth to its stacks of paints and silk-screens, Roaddawgz is in a glorious state of bohemian dishevelment that implies a well-loved space. It could be a messy group studio if not for the load-bearing post in the center of the room covered with flyers for homelessness resource centers and a “missing” poster signed “your Mom loves you.”

We talk about how important it is that the kids Saito works with have a place like this, a spot where they can create “when all you want to do is your art and if you can’t you’ll die.” A career artist herself, she cuts a dramatic figure in black, safety pins, and deep red lipstick painted into a striking cupid’s bow. Her long fingernails tap the cluttered desk in front of her as she tells me stories from the high-risk lives that Roaddawgz youth come to escape: eviction, cop harassment, theft, rape.

The conversation moves to some of the recent developments in the area. Saito and I recently attended an arts advisory meeting convened by the Tenderloin Economic Development Corporation’s executive director, Elvin Padilla, who has received praise from many of the TL types I spoke with regarding his efforts to connect different factions of the community. Attendees ranged from a polished representative from ACT, which is considering building another theater, for students, in a space on Market and Mason streets, to heralded neighborhood newbies Grey Area Foundation, to Saito and longtime community art hub Luggage Store’s cofounder Darryl Smith. Talk centered on sweeping projects that could develop a more cohesive “identity” for the neighborhood.

I ask Saito how it felt for her to be involved with a group whose vision of the neighborhood might be focused on slightly different happenings than what she lives through Roaddawgz. She says she’s been to gatherings in the past where negative things about the Tenderloin were highlighted. Of Padilla’s arts advisory meeting, she says, “I think that one of the reasons I wanted to go was that it’s important [for attendees] to remember that there’s a community out there. Things can get really complicated. It’s hard to come up with decisions that affect everyone positively. If we’re going to say, ‘The homeless are bad; the drug addicts are bad; the business owners that don’t beautify their storefronts…” She trails off for a moment. “I don’t want to lose the heart of the Tenderloin.”

In yet another Tenderloin basement — this one housing the North of Market-Tenderloin CBD, an organization that is known for its work employing ex-addicts and adults in transition — Rick Darnell has created the Tenderloin Art Lending Library. The library accepts donated works from painters and makes them available for use by Tenderloin residents, many of whom have recently moved into their SRO housing and are in need of a homey touch.

Darnell is rightfully ecstatic at the inclusive nature of his library, but has been hurt over its reception at an arts advisory meeting he attended to publicize its creation. “Someone whispered under their breath ‘I would never lend anything to anyone in the Tenderloin,’ ” he tells me. The exclusion that Saito and Darnell sometimes feel highlights the reality that the definition of the Tenderloin might well vary, even among those who are set on making it “a better place.” The arts community appears to suffer from fractures that appear along the lines of where people live, their organizational affiliation, their housing status, and how they think art should play a role in community building.

Sammy Soun is one Tenderloin resident who would welcome an increased focus on art in the Tenderloin. Soun was born in a Thailand refugee camp to Cambodian parents fleeing the civil wars in their country. He grew up in the Tenderloin, where his family lived packed into small studios and apartments.

But he was part of a community, with plenty of support, and lives in the neighborhood to this day, as do one of his four siblings and his daughter. Soun paints, does graffiti, draws — he’s considering transferring from City College to the San Francisco Art Institute. He has worked at the Tenderloin Boys and Girls Club for nine years, giving back to the kids he says “are the future. They’re going to be the ones that promote this place or keep it going — if they want to.” His sister, cousins, and uncles still live in the neighborhood. You might say he has a vested interest in the area’s future.

He finds the incoming resources for the Tenderloin arts scene to be a mixed bag. Soun has never been to the Luggage Store, although it’s one of the longtime community art hubs in the area. He can’t relate to the kinds of art done at the neighborhood’s recent digital arts center, Grey Area Foundation for the Arts, though he says the space has contacted him and friends to visit. His disconnect from the arts scene implies that future arts projects need to work harder on their community outreach — or even better, planning — with artists who call the Tenderloin home.

But Soun loves the new Mona Caron mural the CBD sponsored on the corner of Jones Street and Golden Gate Avenue. Well-known for her panoramic bike path mural behind the Church Street Safeway, Caron painted “Windows into the Tenderloin” after dozens of interviews and tours of the neighborhood with community members. Its “before and after” panels are a dummies’ guide for anyone seeking input on ways to strengthen the Tenderloin community — though the “after” does show structural changes like roads converted into greenways and roof gardens sending tendrils down the sides of buildings, the focal point is the visibility of families. Where children were ushered through empty parking lots single-file in the “before” section, the second panel shows families strolling, children running, a space that belongs to them.

Our interview is probably the first time somebody has asked Soun where he thinks arts funding in the Tenderloin should go. “For projects by the kids in the community,he said.

Truth be told, more art of any kind can only make the Tenderloin a better place — but if you’re trying to improve quality life, focus needs to be on plans that positively affect residents of all ages — art can be a vital part of that, but it should be one part of a plan that ensures rent control, safe conditions, and access to services. After all, if you’re going to rebrand the Tenderloin, you might want to look at the painting on the wall.

A hardly strictly kind of guy

It is not everyday that a San Francisco Bay Guardian culture writer finds herself going for an interview in the Financial District. Something about the fumes of avarice making poor atmosphere for the creative process. But high above the Starbucks and town cars is the banjo-packed office of a rich man who puts on the best free bluegrass festival of the year. And so, for Warren Hellman and his Hardly Strictly Bluegrass (Fri/1-Sun/3), I braved the world of name tags and extravagant corner offices.

Much has been written on the avuncular nature of Hellman. He is an ex-president of Lehmann Brothers, and as chairman of Hellman and Friedman and founding partner of his own venture capital firm, falls just shy of Forbes’ 400 Richest Americans list. He’s a born and bred adherent to a downtown-centric vision of the city, but counts among his buddies union activists and some of the city’s well-known liberal muckrakers. 

But I guess Hellman just likes what he likes. And after I’ve breached the security check-in that takes place in his megalithic office building’s lobby, traveled up to Hellman and Friedman’s well-appointed offices, chit-chatted with his amiable receptionist, and been installed in his office to wait for the man’s arrival from a meeting next door, I realize that central to this category is bluegrass music. His corner office is comfortably packed with stacks of banjos and guitars, a signed CD from Emmylou Harris that wishes him a happy birthday, a metal sculpture that wears aviator sunglasses and a white cowboy hat, thank you plaques from the Berkeley music venue Freight and Salvage, where Hellman is a keystone donor and acted as chairman for the club’s fundraising campaign in years past. It’s impossible to avoid the music in the room, indeed the music is the room

Hellman arrives shortly, limping slightly, but enthused at the prospect of our interview. I tell him it’s great to meet you, Mr. Hellman, an honorific he doesn’t cotton to – Warren it is. He’s wearing a long sleeve denim button down – a look he favors, judging from photos of him taken at different shows and events.

It comes as a shock to the system in this day and age, to meet a billionaire with progressive friends (or, in my case, a billionaire at all), an older man with tattoos who likes to talk glowingly of his trips to Burning Man ensconced in his skyscraper office above the downtown grid. “There’s no fights there!” he tells me of the desert art festival. “Sure, there’s lots of pot, but there’s no violence.” Warren perhaps falls into the eccentric rich guy archetype, but the philosophy inherent in his personal pastimes at times seep here and thre into his politics, at least sporadically. He’s the kind of guy that will endorse the installation of a massive underground parking lot in Golden Gate Park, yet still support closing down the streets that access said lot so that Sundays amongst the trees and museums can be car-free affairs.

So first for the obvious question: why bluegrass, Warren? “People like to ask these ethereal questions,” the man muses in response. I realize quickly that Hellman pulls few punches, answering questions quickly before detouring into favorite stories that more or less illustrate his point. He’s a good talker. “Why do you like bluegrass – why do you like smoked salmon?” 

Fair enough, but why choose to spend your birthday putting on three days of music for the riff-raff (besides the obvious PR bonanza it affords the businessman)? With this query, the billionaire’s eyes alight with a thoroughly unmonetized joy. “It’s the single most fulfilling thing – this is as close to heaven as I’m gonna get,” Hellman says. “To be able to give something that’s really fun to a lot a people that seem to have the same love it as I do… it’s just really fulfilling. And if I could hang out with anyone in my life, it would not be the president of Lehmann Brothers and Goldman Sachs.” 

Hardly Strictly seems to be at its a place that allows Hellman to mingle with people outside the financial business. He’s endowed the festival to continue at least 15 years after he dies. “I’d like it to go on more or less forever,” he says. His desire for meetings of minds across ideological, professional, and personal differences is evident even in the way he conducts our interview — which he treats as though he is meeting a friend for the first time. 

Hellman’s typical routine for this weekend? “You could say what are the peaks of ecstasy,” he chuckles. He worries all week leading up to the event about the weather – this weekend’s sweaty days have perhaps precluded this part — attends the Friday morning MC Hammer (yes, Hammer’s a regular performer at the event) concert for middle schoolers, and then zips around from stage to stage in his golf cart throughout Saturday and Sunday, reaping praise by the untold hundreds of thousands that come to the park to check out the six stages of tunes provided by Hellman each year. 

Oh, and there’s the matter of his band’s performance as well. Hellman plays banjo and sings for the Wronglers, who will be taking the stage at Hardly Strictly at 11 a.m. on Sun/3. They debuted at the festival, and now play gigs all over the country. His travels with the band bring him to bluegrass events year round – when he’s not racing horses, another hobby – and into contact with some great potential acts for Hardly Strictly.

One such group, Hardly Strictly newcomers the Ebony Hillbillies, an all African-American outfit from Jamaica Queens, are Hellman’s personal don’t-miss pick for this weekend. He’s also looking forward to perennial favorites Jimmie Dale Gilmore and Emmylou Harris.

Our time is up, and Hellman’s assistant enters the room to tell him that his next appointment is waiting in the lobby, which doesn’t seem to enthuse him in quite the same fashion that our interview did. Or maybe he’s just good at pretending.

“Oh crap. Well, that was the most fun I’m going to have all day,” he says. Hellman exhorts me to set up another appointment with assistant to talk (“I barely got to find out anything about you!”) and insists on playing me a song about Hardly Strictly that was sent to him by a woman impelled to compose it by her therapist but finally it is time for me to vamoose. We sit convivially, tapping our feet to the beat, Warren every so often blurting out “You have to listen to this part!” Soon, he escorts me to my journey back away from the skyscrapers of the Financial District and returns to his tightly regimented meeting schedule. Moments after our parting, I catch a flat on my bike and am forced to hail a cab to bring me to a neighborhood endowed with such pedestrian things as a bike store. It’s less infuriating than it would have been sans Hellman meet up — I’m still satisfied by our morning time brush between two worlds.

MUSIC The morning of our scheduled interview, he sends me a text message, asking me to push things back a bit. Because he says he’s been up until 5:30 a.m., I figured he’s spent the previous night out being a bad bunny. But my assumptions are incorrect: the self-professed early bird known as Nobunny has stayed up late getting work done. The masked man, who now lives in Oakland, is out and about in San Francisco. I remain patient, knowing that he has plenty on his plate, including the release of his new album and an imminent European tour.

Nobunny’s First Blood (Goner Records) is more polished in production than previous efforts, including Love Visions (1-2-3-4 Go! Records), his breakthrough from 2008. He’s been at it for nearly 10 years now, but our hometown hero’s ascent to garage-rock stardom hasn’t come easy. Before getting off the phone with me, he speaks of darker days in Chicago, where he went from two-time Bozo Show visitor to “lying and stealing heroin addict,” only to be saved by a heartbroken sister and a pre-Hunx and His Punx member of the now-defunct Gravy Train. And by the time I finish interviewing him, he shares some information that I didn’t expect him to delve into, giving me glimpses of original obsessions, addictions, and future ambitions.

Still, at about the 30-minute mark, our first conversation comes to a sudden halt when Nobunny alerts me he has to put money in his parking meter. My time is up. After all, Blag Dahlia of Dwarves fame is expecting him for a radio interview. (Nobunny takes a page out of that fellow Chicago-to-Bay Area transplants’ book by shedding his threads on stage with the exception of the mask.)

I have the sense that Nobunny is holding back a little, like there is a wall. Is he guarded? Maybe a little nervous? He’d publicly admitted to shooting heroin before, but it isn’t until after our initial phone call that he begins to be genuine and upfront about his humbling experiences and the struggle that made him who he is today. All the while, I feel he is in complete control of our interactions, and imagine that’s probably what it’s like to work with someone so self-critical in the studio. The dichotomy of the man behind the mask begins to unravel.

We initially speak through a dodgy cell phone connection, interrupted by distracting wind and disruptive sirens. I’m in the TL, and he’s in the Mission. Both environments are worn down, sort of like the mangy Muppet-looking mask Nobunny wears during show time. He’s lived through misery before. He spent one winter in Chicago with a trash bag serving as his front door, and worked the graveyard shift at a highway gas station during his last year in the city. “I lived in a cage in a squatted grocery store that had become a shooting gallery-crack house,” Nobunny says. “Things were not all right.”

Just a week earlier, I’d seen Nobunny at the Total Trash Fest. He did what he does best: live rock ‘n’ roll, delivered sweaty and in briefs, with some crowd-surfing. The one new song worked into the set hinted at First Blood‘s tone. The album itself clocks in at a short but very sweet 26 minutes. Nobunny rips through the tracks, playing guitar, bass, and drums himself. He gets some assistance from his pal Jason “Elvis Christ” Testasecca, who’s aided him with home recordings in the past, and a couple of other musicians who get honorable mentions in the credits.

“Blow Dumb,” First Blood‘s first single, has been described as “Velvet-y” sounding. Perhaps because the Velvet Underground is associated with New York’s high-art scene by way of Warhol’s Factory, Nobunny points out that the track is a love song to California. It gives a special nod to the Bay Area and hyphy, but also shows some love for SoCal, with a possible Burger Records shout out. The end result is ideal for a groovy road trip with friends, riding down Highway 1 with nothing better to do than smile in the sun.

Content-wise, not everything on First Blood is so buoyant. Elsewhere, Nobunny’s lyrics confront sexual desire, unbalanced relationships, inner weakness, and the self improvements necessary to pull yourself out of the proverbial gutter and see the world. Plenty of lustful longings are laid out as he expresses exactly what he wants in the twangy-sounding “Pretty Please Me”: a noncommittal fling, no questions asked, just as long as it feels right.

The blatant “(Do the) Fuck Yourself” conjures up perverse images straight from Nobunny’s stage show, where his masked persona goes public, employing ball-gags while prancing around scantily-clad. When we finally meet in person, I ask him where these antics come from. His answer is quite simple, and makes sense coming from a rabbit, “I’m just horny,” he says. All the while, in order to maintain a “shred of anonymity,” he wears his favorite deranged-looking mask. It never seems to come off.

“I don’t think I’d like to deal with being in an un-masked band at, say, Hunx’s or Thee Oh Sees’ comparable level of popularity.” Nobunny says, when asked about the get-up. “Knowing eyes are on you when you are not on stage sounds maybe not always fun.” Nonetheless, a fruitful creative partnership with Hunx has been vital to Nobunny’s survival: “Seth [Bogart, a.k.a. Hunx] has been a very supportive friend, and, yes, in some ways I feel he saved me, or at the very least vastly improved my living situation.”

Though Nobunny often expresses the wish to record and play alone, he’s no stranger to collaboration, including a recent live session with Jack White at Nashville’s Third Man Records. Not all dream teams come true, though — since childhood he’d hoped to work with another master of disguises, the famously introverted King of Pop. “Michael Jackson was my first obsession, ” he says. “I wanted to be him. I still want to be him. According to Rocktober’s History of Masked Rock ‘n’ Roll, MJ was a masked musician with all his surgeries and what not. We all wear masks, some are just easier to spot than others.”

Speaking of costumed camouflage, First Blood‘s final track, “I Was On (The Bozo Show)” is a psyched-out, swirling down-tempo dirge with many levels of dedication. One could read it as homage to the late clown-god Larry Harmon (a.k.a. Bozo), as Nobunny hazily recalls his lost innocence and how he sat in the back row of a Chicago television with his little brother to meet the world-famous archetype on two separate occasions. Yes, Nobunny was on The Bozo Show — twice.

But behind its showbiz facade, “I Was On (The Bozo Show)” is also an agonizing confession from a former addict. “It’s for my blood brother and sister as well as my friends who struggle with drug addiction,” Nobunny says. “In another time, clowns made children happy and the circus was fun, but now they’ve become just another relic of past, tarnished by the more common association that their images are horrifying and that they are to be feared. I’m pretty sure no Juggalo ever went to clown school.”

A mythical creature from garage rock’s underbelly, Nobunny has earned his success, even securing a gig at the Playboy Mansion in L.A. as part of his 10-year anniversary celebration next Easter. But he’s no stranger to the addictions he sings about on First Blood final track. “My sister had been buggin’ me a bit to come visit her in Arizona, and I finally decided to take her up on it before I killed myself,” he says, still discussing “I Was On (The Bozo Show)”‘s origins. “I drove across the country shooting dope the whole way to the desert west of Tucson. She didn’t even know I was using. She nursed me back to health out there all alone in the desert. Our only neighbor was an 80-something yogi from India who was out there on a 30-day silent meditative prayer.”

If that sounds like material for a boulevard of broken dreams tell-all, in all seriousness, Nobunny has come out of the experience stronger, poised for new adventures, but most of all, grateful. “I am thankful to have enough fans to make touring worthwhile,” he said. “While I’d still be writing and recording and performing with no one looking, it’s really nice to see people at our shows dancing and singing along and smiling.”

CityPlace, USA — and why Newsom wants developers involved in district elections

Speaking at the San Francisco Mariott Hotel today, Sept. 14, to a room packed full of developers, land-use attorneys, building owners and managers, members of the San Francisco Convention & Visitor’s Bureau, and others who had gathered for a San Francisco Business Times event, Mayor Gavin Newsom championed a retail development project proposed for San Francisco’s mid-Market area that is being opposed by Livable Cities and the San Francisco Bicycle Coalition. The project will come under consideration at today’s Board of Supervisors meeting.

“CityPlace will be an anchor of revitalization” in mid-Market between Fifth and Sixth streets, Newsom said. Members of the Board of Supervisors may try to block it, he added, but “we can’t afford to let that happen. It’s a quarter of a million square feet, and it connects right up from Nordstrom’s.”
“CityPlace is critical,” he added. Marcia Smolens of public relations firm HMS Associates is representing Urban Realty, the developer of CityPlace, according to a file included in the Board of Supervisors meeting packet. Smolens contributed $2,500 to Newsom’s run for Lieutenant Governor. An architect with a partnering firm on the project, Gensler, plunked down $1,000 for Newsom’s campaign.

The mid-Market area has long faced issues of blight and crime. Newsom put forth a vision for its revitalized future that would include “more cops” (the development would connect with a police officers’ substation planned near Sixth and Market streets, Newsom noted), a creative bent thanks to partnerships with artists, and an area “a little less crowded with folks panhandling.”

The proposed development is essentially a large glass box with a shopping mall inside. According to the project website, Urban Realty has not yet engaged potential tenants, but appears geared toward attracting low-end retail chains. “We intend to bring affordable, value-based retail tenants to the area and expand the shopping choices available to make this section of Market Street a shopping destination that truly caters to San Francisco’s diverse demographic,” the website notes. Our guess is that they aren’t talking about unique, independently owned thrift stores that offer affordable used items and encourage shoppers to support small business, but something more along the lines of TJ Maxx.

The project would also include 188 parking spaces in an underground garage. In contrast, the Westfield mall near Fourth and Market streets was built with no new parking.

Livable Cities has filed an appeal of the Environmental Impact Report (EIR) for CityPlace on the grounds that transportation issues weren’t adequately dealt with, and the board will vote on the appeal today after opening the item up for public comment. Livable Cities executive director Tom Radulovich noted that the project would demolish the St. Francis Theater, a 1910 building that some had envisioned as a structure that could be rehabbed as part of a revived theater district in that area. He also felt the development was out of character for the neighborhood. “They’ve been given a lot of bonuses, like surplus parking and an excess floor,” Radulovich noted. “We feel like the Planning Department gave them a lot more value — millions of dollars worth. The public should get something out of it.” Partly out of a desire to improve the area, he said, mid-Market amounted to a sort of “Wild West in terms of planning. That’s been the story is that the only way to move forward is to throw away our rules.”

The developer estimates that the project would create up to 250 union jobs during construction, and 760 new permanent retail positions (that is, non-union, low-wage jobs with high rates of turnover — but at least it’s something). This could present a quandary for supervisors who might otherwise hold their nose at the idea of approving a big-box mall in the heart of San Francisco. Construction workers are in dire straits right now, and unemployment in the city is nearing 10 percent — and even higher in communities of color such as the Bayview.

Meanwhile, Newsom urged the crowd of downtown real-estate big shots to get involved in disctrict elections for the Board of Supervisors, lest “you wake up and things get worse quickly.”

The mayor issued a strong warning that “ideology is too strong in this town,” and then referenced the Guardian, speaking to some dangerous influence wielded by “these people who write these blogs.”

“You are the only thing standing between a dramatic shift off course in this town,” he told the crowd. “But our opportunities are limitless as long as we have stable leadership. Please take the time to learn about these candidates. Get involved – even in the districts you don’t reside in.”

At the end of Newsom’s speech, everyone applauded and then turned their attention to a short, flashy video about America’s Cup.

Blocking the bridge

The Sierra Club and Golden Gate Audubon Society have sued to block the final environmental impact report on the Lennar Corp. redevelopment project, a move that could force reconsideration of a bridge over Yosemite Slough.

The suit against the city, Board of Supervisors, and Redevelopment Agency charges that the final EIR for Lennar’s Candlestick Point-Hunters Point Shipyard project was inadequate, in part because it didn’t consider all the impacts of the bridge or look properly at alternatives.

The move comes as no big surprise: these environmental groups vowed to file a suit within 30 days of the city’s August certification of the project EIR. But advocates hope it will lead to a change in the proposal.

Arthur Feinstein, a member of the Sierra Club’s San Francisco Bay Chapter, said the EIR didn’t comply with the California Environmental Quality Act, or CEQA.

The introduction to the Sierra Club suit notes that “the FEIR failed to identify or underestimated the significance of environmental impacts associated with the project; failed to address the alternative proposed by Arc Ecology, which provides for a bus rapid transit route around Yosemite Slough; and failed to provide adequate responses to comments on the draft EIR.”

Or as Feinstein puts it: “There’s a bridge, and it’s going through a nature area where they say the sound level from the buses will be the equivalent to standing 50 feet from a freeway.

“They say there is no impact and that you can’t have an undisturbed nature experience in an urban area, but you can,” Feinstein continued, pointing to the Presidio, Golden Gate Park, and Crissy Field as examples of places where you can have undisturbed experiences.

Feinstein noted that Candlestick Point State Recreation Area is the only large park on the city’s eastern shoreline, and the only park that people in the Bayview can access easily.

“The city boasts about how much it was improving the Bayview, but this park is the only major open space where you can get away from urban stress — and folks have a lot of stress in the Bayview,” Feinstein said. He added that building the bridge will involve sinking pilings in Yosemite Slough that will disturb wildlife and stir up PCBs and other known contaminants.

“Noise, light and glare all have impacts on wildlife, but the city’s EIR said these are insignificant because these critters are insignificant,” Feinstein said.

Feinstein noted that the city’s final environmental impact report did make a finding of overriding concern that the project will cause air pollution at levels that exceed Bay Area Air Quality Management District (BAAQMD) health standards.

“But [the city] decided that this was a regional problem, so they did not attempt any mitigations for the 25,000 new residents that this 700-acre redevelopment plan is supposed to bring into the Bayview — which already has the city’s highest asthma and cancer rate and the largest number of polluting sources,” Feinstein said. “But they could say that all buses going into the development need to be electrified, or they could limit the number of parking spaces the way they did at Octavia-Market and South of Market.”

Feinstein said the next step in this CEQA lawsuit in a pretrial negotiation session to see if a settlement can be reached. “We’re not looking for a long drawn out fight. We’re ready for one, but we’re also ready to negotiate because that’s how you achieve things.”

Feinstein also noted that the Sierra Club had to go to Los Angeles to hire a traffic consultant to work on its suit because Lennar has contracts with just about every shop in the Bay Area, thanks to its various projects at Hunters Point, Treasure Island, and Mare Island.

“The related problem is that the city is no longer looking at the project with a steely eye,” Feinstein said. “Instead, they have become the developer — except that they are working with Lennar and not reviewing Lennar’s plans with objectivity. By filing this lawsuit, we’re keeping the conversation about this project alive and reminding folks that you don’t have to take everything this mayor and his administration gives you.”

The Sierra Club/Audubon Society suit came four days after the San Francisco Chronicle reported that the California State Parks Foundation entered into an agreement with Lennar to help prepare conceptual designs that reportedly will be used as the basis for the actual bridge over the Yosemite Slough.

Some critics interpreted the timing of CSPF’s announcement, which the Chronicle reported under a confusing “Environmentalists to help design span” headline, as an attempt by Lennar’s well-oiled PR machine to undermine the Sierra Club/Audubon Society suit.

They also questioned CSPF’s independence from Lennar, and from the Mayor’s Office, because Guillermo Rodriguez Jr. from the Mayor’s Office of Economic and Workforce Development sits on CSPF’s board. So does Peter Weiner, a partner at Paul, Hastings, Janofsky & Walker, which has contracts with Lennar. Representatives from Southern California Edison, Toyota, the Walt Disney Company, Pacific Gas and Electric Co., and several other companies that either have contracts with Lennar or have given to Mayor Gavin Newsom’s campaign for lieutenant governor campaign also sit on the park foundation board.

CPSF’s President Elizabeth Goldstein told us that “as park supporters and defenders, we consider ourselves environmentalists.” CSPF originally planned to fight approval of the project’s final EIR when it came before the board in July. But unlike the Sierra Club, CSPF pulled its appeal at the last minute.

Goldstein told the Guardian that the foundation reversed its decision because it had initiated what she characterized as “a fruitful discussion with Lennar.”

“We wanted to play that out,” Goldstein said. “And now we’re glad we did, because the design criteria look quite good and hopefully will be compatible with the project.”

“What we’ve agreed with Lennar about is a set of design criteria to be applied to the bridge, she continued. “These criteria are intended to make sure the bridge fits aesthetically into the park as much as is possible. Lennar asked us, and we agreed, to develop the first set of conceptual plans — obviously in cooperation with them — to make sure that they are, from their first iteration, as sympathetic as possible to the park.”

Goldstein said that some of these design criteria are “quite global.”

“Some are big arcs of things that are very important to us, such as impact from light, glare and noise,” she said, noting that they don’t want to see the proposed bridge lighted at night, à la the Golden Gate Bridge.

“We want the environment at dusk to be as unimpacted as possible,” she said.

Other CSPF concerns are more situation specific.

“We want safe, attractive, easy-to-use signage,” Goldstein said, referring to need to help users and neighbors find their way around and across the bridge. “We also talk about minimizing piers in the water at the slough, and if possible, eliminating them altogether since they impact vehicles and kayaks.”

Goldstein agreed that the foundation’s roots are not in political advocacy. “We were founded as a philanthropic land acquisition partner to the Department of State Parks.” But she noted that the group was involved in blocking a proposed toll road through Orange County and is a leading supporter of Proposition 21, which seeks to raise nearly $500 million a year for state parks by tacking on an $18 vehicle registration fee that would give all vehicles registered in California free access to the majority of state parks.

As Feinstein observed, “The CSPF does great work, but they are not usually advocates for conservation and biodiversity. That is what the club and Audubon Society does.”

Stuart Flashman, attorney for the Sierra Club and the Golden Gate Audubon Society, said that in the long run the lawsuit won’t stop the project from going forward. “But in the short term, if the court finds that the EIR wasn’t adequate and that there are significant impacts from the bridge that could have been avoided, then the city has to go back and redo that part of the EIR, a process that could take two to four months. And if they conclude, yeah, the impacts from the bridge are unavoidable, then they’d have to redo it to go around the slough.”

Flashman says he hasn’t seen the proposal CPSF and Lennar are working on. “But as part of this suit, we are required to sit down with the city and see if we can settle — and we are hopeful we can do that.”

Endorsement interview: DeWitt Lacy

DeWitt Lacy wants District 10 to get its fair share — of the city’s economic pie, of the programs that serve San Franciscans, of the parks and infrastructure that San Francisco pays for. He complains that the district has some of the worse environmental problems in the city “and we don’t even protect the parkland we have now.” He’s taking a generally progressive approach — he opposes sit-lie, is against the gang injunctions, and supports all the revenue measures on the fall ballot. He also thinks the city makes it too hard on the working class; in fact, he complained about the cost of parking tickets, saying they’re a real burden for people trying to support a family on moderate incomes. And he’s concerned that the emphasis on housing in the city’s Eastern Neighborhoods Plan could impact light industry.

Herrera’s gang injunction becomes part of D. 10 dialogue

As stated in this week’s article about City Attorney Dennis Herrera’s Viz Valley gang injunction, Herrera’s move gives D. 10 candidates an opportunity to show they are tracking all the issues in a district that is home to the city’s largest public housing site.

As C.L.A.E.R. Project director Sharen Hewitt put it at a debriefing session about the injunction, “D. 10 has been reduced to the Lennar issue, and that’s what’s criminal.”

And the injunction is becoming part of the dialogue in the D. 10 race, with eleven candidates in that race sounding off on the injunction, many of them critiquing Dennis Herrera’s approach and/or advocating for legal representation for those named in the suit, and more services in this historically neglected district.

Candidates Isaac Bowers, Kristine Enea, Chris Jackson, Nyese Joshua, Steve Moss and Marlene Tran attended Hewitt’s August 12 gang injunction debriefing.

And by meeting’s end, Bowers and Enea said they would help community members get legal representation.
“A lot of people being served, don’t know what an injunction is, or don’t show up at the hearing and then they become subject to the injunction,”  Bowers said.

Enea said she was glad that City Attorney Yvonne Mere clarified at the debriefing that the 41 young men named in Herrera’s filing could not be included in the actual injunction until they have been served.

“It was important to clarify the notice process,” Enea said.

Jackson said he’s committed to helping these men access job and education opportunities.
“If you i.d. folks as low-income gang members, there is a lot more you can do than simply hand over their names to law enforcement,” Jackson said.
“Before the City Attorney puts in a gang injunction, that office should talk about it with the community.” Jackson continued. “Ultimately this is about land use.”

“For the City Attorney to have a top down approach to gang injunctions is unfortunate,” Jackson said, noting that Herrera’s injunctions have been in predominantly
African American and Latino neighborhoods.

“And in terms of taking away people’s civil rights, it’s unacceptable, “ Jackson added, noting that the City Attorney’s list of targeted individuals is public information.

Reached by phone, Moss says he’d like to see a time limit imposed on gang injunctions. Currently, injunctions are indefinite, once they have been granted.

“I haven’t studied the precise details,” Moss said, noting that he went to Hewitt’s debriefing and has leaved through materials the City Attorney’s Office provided.
“Generally, no one likes gang injunctions because they potentially threaten civil liberties and sometimes the city gets it wrong,” Moss said, referring to cases where folks have been wrongly named in previous injunctions. “But in places where injunctions have been brought, they do seem to have reduced the violence and calmed down the district. I’d like there to be a time limit, a sunset clause.”

D. 10 candidate Marlene Tran said she thinks the injunction could help reduce violence in the neighborhood.
“I was trying to listen to the different input at the debriefing session,” Tran said. “But on TV, I heard that when Herrera talked to the Chinese press, he cited some 200 incidents in the proposed safety zone. About 100 of those incidents involved guns, and there have been ten homicides in three years. Those are really glaring statistics. And this morning I read that there is another injunction in Oakland, and they talked about success with gang injunctions in Salinas, where the homicide rate dropped from 50 to 5, compared to 2008/2009.”

Tran, who sits on the Community Advisory Board for the Police Department’s Ingleside Station, said she heard from Ingleside Captain Louis Cassenego that he wants to serve all 41 respondents named in the injunction peacefully.
“If this is done without any casualties to the district and the community, and if it prevents any further violence, then this is the way to go,” Tran said.

Tran expressed some due process concerns.
“If they spend that much personnel and time [on putting the injunction together], it should be done with due process,” Tran said.

But she feels the current level of violence in Viz Valley is unacceptable.
“I’ve lived here for twenty something years, and if you talk to residents and children, who wants to hear gun fire,” Tran said. “So I think we have to work for a peaceful community to prevent these problems. That’s why we call ourselves the emergent district.”

D. 10 candidate Ed Donaldson believes the injunctions are a product of neglect.
“It comes back to a question of overall neglect in the district,” Donaldson explained.  When you have that level of social and economic neglect, gang injunctions become “necessary’. But when you look at the resources coming into the district through local non-profits, which comes, I believe to $110 million a year, 80 percent of which is city money, paid mostly to non-profits that may not be based in the district, you have to ask, Are we getting what we paid for? And do these non-profits have enough integrity to make sure there is a level of impact to transform people’s lives? “

Donaldson says that, given the overall level of neglect in public housing, it’s not surprising the district has challenges.

“So, are we willing to invest in the neighborhood in a very transformative way, or are we going to continue to give money to police and prisons?” Donaldson asked.
He notes that every year, 1,600 men and women return to the southeast side of San Francisco, and there is a 71 percent recidivism rate among these folks.

“Why is this rate so high in a progressive city like San Francisco?” Donaldson said. “Part of the answer lies with our public housing policy: if you can’t get public housing, you can’t apply for a job, you can’t go to school to better yourself.”

Donaldson says there is a direct connection between the district’s homicide rate and the people getting out of prison, returning to the district and re-offending.
“So, what’s so hard about getting our arms around 1,600 people a year and stabilizing them? Because then a lot of stuff about public safety will go away.”

D. 10 candidate Tony Kelly believes that if there were gangs in Viz Valley, then Herrera’s injunction would be valid.
 “There is gang-like activity, but it’s small scale turf wars, shootings and retaliations, and it’s not organized,” Kelly said. “ Instead, you’ve got unorganized young black men with no other options, doing whatever it takes to get ahead. But instead of doing something constructive, the City Attorney calls them gangs.”

Kelly notes that the City Attorney claims that most of the individuals named in the Viz Valley injunction don’t live in the proposed safety zone.
“But according to what I’m hearing on the ground, a bunch of them do live here and/or grew up here,” Kelly said. “So, we want their families to get involved. They need safe havens. But combined with last year’s budget cuts, all this does is criminalize young people and pushes the problem around. As long as we have 40-50 percent unemployment, we are not going to solve our crime problem.”

DeWitt Lacy, also a D. 10 candidate, said he is concerned that gang injunctions are circumventing people’s due process rights.
“In a criminal case, you have the right to an attorney, but that’s not so in a civil action,” Lacy said.

Lacy worries that gang injunctions lend themselves to racial profiling.
“Folks have to stay in their house or quickly go to and fro because they can’t hang out in the neighborhood,” Lacy said. “A smarter approach would be to do community policy that Sup. Ross Mirkarimi introduced in the Western Addition. It’s been shown to have a positive impact on criminal activity. We should have officers walking around in troubled areas. The more we change a foot patrol pilot into citywide policy, the more we actually address serious issues and problems. Everyone understands the value that police bring and everyone wants to be able to rely on them. When we only use police to bring a punitive action it reinforces the notion that they are evil enforcers.”

D. 10 candidate Malia Cohen said she was concerned by Herrera’s approach.
“I think we need a more comprehensive approach, otherwise, we’ll simply be moving crime two blocks over,” Cohen said. “We need long-term, not short-term solutions.”

Cohen noted that there are Chinese and Russian gangs in town, as well as African American ones, and Latino gangs like the Nortenos and Sudenos.
“But the style of how each gang manifests is different, which makes African Americans an easy target. We need to have a uniform approach to how we deal with this.”

The 41 men identified in Herrera’s latest injunction all appear to be African American, and many have family ties and roots in Sunnydale, meaning the injunction impacts a much larger circle of folks than those simply named in Herrera’s filings.
“The impact on families caught up in this can’t be overstated,” Cohen said.  “Either they’ll have to take bus down to court, or drag down and pay hella money for parking, and for food, and even take a day off from work if they are employed. And then there’s the emotional effect. We could be using our resources in a more productive way. I understand that Dennis Herrera is ambitious, but this is playing on people’s racism. It’s tantamount to ethnic cleansing. Maybe Herrera wants to be seen as tough on crime, but ut how about being seen as big on compassion? Or big on fair? This is not going to help people get jobs and housing. And it prevents American citizens from being able to travel.”

Eric Smith, also a D. 10 candidate, says it’s right to question the injunctions.
“David Campos and Eric Quezada both expressed concerns about Herrera’s injunction against the Nortenos, when they were running in the 2008 race for D. 9,” Smith observed.
“They talked about the unintended consequences of that injunction in terms of deporting folks who then train the next generation in the ways of gangs.”

Smith questions how effective gang injunctions are in the long-term.
“They are a band-aid,” Smith said. “This is like putting a finger in the dike, or using a hammer to kill a flea. Because the root causes are not addressed. If you don’t deal with young people’s lack of education and joblessness, their hopelessness, their choicelessness, the gang becomes their family. So, if the city did community policing and had great youth programs, it would help.”

Smith, who is a professional jazz musician, wants to see more music, poetry and spoken word programs and activities in the neighborhood.
“There’s a lot of untapped talent,” he said. “When you have arts, music and theater, those are life-saving opportunities.”

Also a bio-diesel advocate, Smith wants to see people who are returning to the community after a stint inside, being able to access green jobs, instead of doing more of the same stuff, only better, than the activities that landed them inside in the first place.

“I care about everyone in the district, but most of all about those who have been kicked to the curb and end up in gangs, on drugs, or dead.”

And D. 10 candidate Diane Wesley Smith believes there are better solutions than gang injunctions

“African American culture is almost opposite in terms of physical mannerisms and gestures and tone of voice, and that can be scary to someone who is used to being conservative,” Wesley Smith said, speaking to the rising tensions between some black and Asian residents in the district.

“I believe these things could be solved with town hall meetings, where there is food and translators so folks could talk things out, “ she said. “It’s never going to be worked out through the police. Only law enforcement benefits from these kinds of proceedings. We need to reach out and touch each other, so that the Chinese community knows that the black community has the same goals as they do, which are employment, housing and safety.”

“When we talk about violating people’s civil rights, posting people’s pictures on websites, preying on people’s fears, well, that’s how we got into the war,” Wesley-Smith said. “Unemployment. Lack of access to opportunity. Lack of education. No money for our schools, but an increase in spending on our jails. These all send the same message: You are not wanted.”

Wesley Smith is concerned that the gang injunctions will accelerate the mass exodus of blacks and people of color from San Francisco.
“We all want a safe San Francisco,” she observed. “The solution is more jobs, not war. People are just going to go more underground in face of these injunctions. Meanwhile, the kids in my district don’t have toilet paper or computer paper in their schools.”

“I understand that Dennis Herrera is a career politician, and time will tell what his true aspirations are, but this is not legislation we propose in a caring society,” Wesley-Smith concluded. “We’re not showing any of these kids any love. All we need to do is partner with business and government and work this out. Te thought that four men standing on a corner drinking an energy drink could be considered gang members is shocking. That’s how they perpetuated slavery, and that’s why blacks have problems today. All my nephews dress similarly. So, are we going to consider them gang members? The good and the bad kids dress the same. We need people and parents to understand that none of us can be safe, until we take care of those who have the least in our community. I’d venture that everyone who is a safety concern has not pursued their education, has not been assisted in pursuing education, and has not been assisted in pursuing employment.”

D. 10 candidate Lynette Sweet promised to call me back to talk about the gang injunction, and if and when she does, I’ll be sure to include her comments here. The same goes for Nyese Joshua, Geoffrea Morris and Steve Weber  who had not returned my calls as of blog time, and for any other D. 10 candidates that I was unable to reach for this article. Directed by Mario El Caponi Mendoza, this experimental play concerns an anonymous woman and a triad of men who are three different versions of her son. Mommy goes mad, and potentially murderous, as she finds herself in the hell she’s created. The production is also inspired by Susan Eubanks who, like Yates, murdered her sons. It’s easy to reflexively dislike Boris, if only because it’s the one heavy band that a guy wearing a purple keffiyeh to a cocktail party will profess his undying affection for. But despite all the too-cool-for-school trappings, the Japanese trio is a potent rock ‘n’ roll force, combining drone, doom, and scuzz into a noisy, inimitably raw package. It’s a particular favorite of the band’s fellow musicians, having collaborated with SunnO))), Torche, and the Cult’s Ian Astbury, with whom they’ll release a four-track EP in September. “Dark in August: Rare Vampire Films”

For folks of the ever-more-prevalent view that vampire cinema these days totally bites, the Yerba Buena Center for the Arts is here to staunch the wound. Over four days, it is screening bloodsucking fare from decades past, kicking off with Kathryn Bigelow’s cult Western-tinged fang flick Near Dark (1987). The following days bring Vampire Hookers (1978), ostensibly a trashy vamp romp shot in the Philippines and starring David Carradine; and two showings of Vampyr (1932), Carl Theodor Dreyer’s first sound film. Hookers is reportedly standing in for an unsatisfactory print of Daughters of Darkness (1971), but it seems the range of camp to class will still be maintained. (Sam Stander)

A Web browser-based digital art piece, Richard S. Mitchell’s new work comprises millions of single-colored frames, across the spectrum that makes up the RGB color model. It runs for seven days, 18 hours, 24 minutes, and 48.64 seconds, and is simultaneously viewable from any computer that accesses the Jancar Jones Gallery website. That may seem like a mouthful of data, and there’s more to be had on the site, but little in the way of stated intent or contextual mumbo-jumbo. This is a minimalist exercise focusing on color rather than shape and allowing anyone, anywhere to synchronously experience a nonstatic piece of art. But if you want to rub elbows with other appreciators, it will be showing in the gallery for three hours. (Stander)

Valerie Orth is a sexy, soulful singer-songwriter whom I’ve been lucky enough to catch for truly memorable sets ranging from a powerful performance at Cafe du Nord to an intimate acoustic session rolling across the playa in an art car with a konked out generator at Burning Man last year. Now the SF artist has just come out with a new album, Faraway City, that beautifully captures a voice and style that is reminiscent of Ani DiFranco or Björk, two of her key influences. The album, filled with catchy original songs developed over the last two years, was produced by Jon Evans, another local who plays bass for Tori Amos and helped record music for the likes of Tom Waits, Third Eye Blind, and Boz Scaggs. If you combine Jana Hunter’s saturnine vocals, or found (like Nico’s) between masculine and feminine, with Will Adams’ shoegazing guitar, you get what sounds like something caught in the wind. Or sometimes you get music that sounds like was recorded in the most depressing bedroom ever. For the most part, the Baltimore, Md., quartet Lower Dens keeps things in a minor key, and its 2010 debut Twin-Hand Movement glistens with brooding songcraft, riding a dark and stormy (new) wave. This band was already on the rise before it was stabbed with a certain Pitchfork, as Hunter had been kicking it solo since early in the aughts. (Lattanzio)

Mustaine: A Heavy Metal Memoir

Dave Mustaine has seen more than his fair share of difficult obstacles to overcome throughout his musical career due to his past drug and alcohol addictions, which famously got him kicked out of an early Metallica lineup. How to save Muni

Editors note: In this week’s paper, we offered a series of proposals for discussion at the community congress Aug. 14th and 15th. Here’s one that we couldn’t fit:

San Francisco is a transit-first city, yet its bus system is perennially in crisis. Everyone knows Muni needs fixing—but how do we do it in a way that honors the needs of both drivers and riders, while deepening San Francisco’s commitment to sustainability and transit innovation? How do we maintain and improve service when Muni and the San Francisco Municipal Transportation Agency face deep budget deficits and service cuts on a regular basis?

Here are a few priorities that Muni advocates have identified:

1. The discussion around MUNI must include everyone–motorists, Muni drivers and riders, neighborhood groups, business people, labor groups, low-income people, communities of color, seniors, youth and the disabled. 

2. Muni drivers should be encouraged and empowered to take an active part in the discussion.  In order to creatively address Muni’s operating problems, we must tap into the knowledge and experience of those on the front lines driving our buses.

Accountability, reasonable work rules and good performance are essential. While changes to the current work rules and practices deserve consideration, it must be recognized that Muni drivers have difficult jobs and important responsibilities that warrant good pay and proper respect—from both Muni riders and SFMTA Management.

3. An outside financial audit of the SFMTA should commence immediately.  The audit should include an analysis of how overtime is assigned, how other departments assess Muni for services, and how developer transit assessment fees and other revenues for Muni are assessed and collected. 

4. There’s been no management audit of the SFMTA since 1996.  Such an audit is long overdue, and should be performed as soon as possible.
Some other recommendations discussed at a Muni summit this spring:

A) Improving the flow of Muni Vehicles.  In September 2009, SFMTA Executive Director Nathaniel Ford supported the idea of conducting test programs to improve the flow of transit vehicles on congested streets such as Stockton Street and Columbus Avenue.  To date, there has been no follow through on this promise.  Action on this should proceed at once.

B) Priority for Light Rail Vehicles.  We must take steps to prevent trucks, automobiles, bicycles and pedestrians from slowing down light rail vehicles.  This would include pre-empted signals, signals in place of stop lights and traffic barriers, and eliminating the queues of automobiles that block the flow of light rail vehicles.  Similar steps would help facilitate the flow of buses: eliminating parking lanes on certain streets, limiting deliveries to off-peak hours and creating special parking zones for trucks.

C) Improved Customer Service. Buses will run faster and more smoothly with greater emphasis on getting riders to the back of the bus.  This would involve stationing rear door loaders to sell and collect tickets during peak commute periods. Conveniently located ticket vending machines would help speed up the loading process and allow passengers to pay fares with either credit cards or cash.
Funding and Costs

We all know that Muni must be adequately funded and efficiently run – but how?

To boost Muni use and revenues, the city can:

Work with large and small employers, apartment owners, residential developers and Municipal permitting authorities to provide incentives for people to use Muni Fast Passes and/or TransLink. 
Create a moderately priced all-day pass, and a higher cost day pass also valid on ferries and commuter bus services. Along major commercial corridors, businesses and employers who benefit from Muni should help subsidize the system — for instance, through progressive impact taxes.

Increase parking meter fees/hours/days and garage taxing rates as appropriate.  Eliminate parking exemptions, discounted all-day parking (except for neighborhood protected parking) and all other special parking privileges.

These are just some of our ideas.  We invite you to attend the Community Congress to continue this important dialogue and draft your own recommendations on transit issues. 

Board progressives ditch their own tax measures

After failing to win support from the small business community for a measure that would have helped it and fearing a well-funded attack from large corporations, Board of Supervisors President David Chiu today made the motion to reject his business tax reform ballot measure.
Labor leaders have also raised concerns about not having enough resources to fight for several revenue measures on the November ballot, mostly because they are focused on approving a hotel tax increase, supporting progressive supervisorial candidates, and defeating Jeff Adachi’s measure to increase how much city employees pay for health care and into their pensions.
“There is still not consensus about whether this should move forward,” Chiu said of his measure, which also suffered from being complicated and not easy to explain in an election campaign. It would have created a more progressive payroll tax structure – increasing taxes on large corporations and lowering them on small businesses – and a commercial rent tax that also would have exempted small businesses, raising about $25 million for the city and creating hundreds of private sector jobs, according to the city’s Office of Economic Analysis.
But the fear among some progressives is that too many revenue proposals would hurt their individual chances, given that the ballot will now include a hotel tax increase, a real estate transfer tax on properties worth more than $5 million (which the board approved today on an 8-3 vote), a $10 local surcharge on vehicle license fees, and a parcel tax from the Community College District.
So Sup. Ross Mirkarimi today also abandoned his proposal to increase the city’s parking tax from 25 percent to 35 percent, which would have raised about $25 million per year. Both Chiu and Mirkarimi said their measures were good policy and would have raised desperately needed revenue, but they were bowing to political reality.
“We’re challenged by the practicality of mounting a fall campaign around these revenue measures,” Mirkarimi said at the meeting.
The board voted 10-1 to table both measures, with a dissenting vote by Sup. Chris Daly, who said, “I just disagree with that political analysis.” He said voters would consider the measures individually and “I don’t think disappearing a progressive payroll tax and progressive parking tax are going to help the real estate transfer tax.”

City Hall standoff

Backroom politics, vote-trading, threats, and tricky legislative maneuvering marked — some would say marred — the approval of the city’s 2010-11 budget and a package of fall ballot measures.

For weeks, Mayor Gavin Newsom had been threatening to simply not spend the roughly $42 million in budgetary add-backs the supervisors had approved July 1, mostly for public health and social services, unless they agreed to withdraw unrelated November ballot measures that Newsom opposes (see "Bad faith," July 14).

The board’s July 20 meeting included a flurry of last-minute maneuvers interrupted by an hours-long recess during which Newsom, Board President David Chiu, and their representatives negotiated a deal that was bristled at by progressive supervisors and fiscal conservative Sup. Sean Elsbernd.

Ideological opposites Elsbernd and Sup. Chris Daly voted against motions to delay consideration of several measures — including splitting appointments to the Rent, Recreation and Park, and Municipal Transportation Authority boards; revenue measures; and requiring police foot patrols — until after approval of the city budget.

"What is the connection between [seismic retrofit] bonds and the budget?" Elsbernd asked as Budget Committee chair John Avalos made the motion to delay consideration of the $46 million general obligation bond Newsom proposed for the November ballot.

Avalos made an oblique reference to "other meetings" that were happening down the hall. Daly then criticized the maneuver, noting that "vote trading is illegal," later citing a 2006 City Attorney’s Office memo stating that supervisors may not condition their votes on unrelated items.

But that didn’t stop supervisors from engaging in a complex, private dance with the Mayor’s Office and other constituencies that day. In the end, the board approved the budget on a 10-1 vote, with Daly in dissent. Then Chiu provided the swing vote to kill the progressive proposal to split with the mayor appointments to the Recreation and Park Commission, with Sups. Daly, Avalos, Ross Mirkarimi, David Campos, and Eric Mar on the losing end of a 5-6 vote to place the measure on the fall ballot.

A measure to split appointments to the Rent Board was defeated on a 10-1 vote, with Daly dissenting, although that seems to be tactical concession by progressives. Campos, who sponsored the measure, said landlord groups were threatening an aggressive campaign against the measure that would also seek to tarnish progressive supervisorial candidates.

Removal of an MTA reform measure from the ballot, another mayoral demand, was also likely at the July 27 meeting (held after Guardian press time). Chiu told his colleagues July 20 that he was still negotiating with the mayor on implementing some of its provisions without going to the ballot this year.

Chiu rejected the notion that he cut an inappropriate budget deal, saying he was concerned the split appointment measures would be portrayed as a board power grab, noting that community groups need the funding that Newsom was threatening to withhold, and saying the board’s threats not to fund Newsom’s Project Homeless Connect facility and Kids2College Savings program were also factors in the deal.

"We were engaged with a number of conversations, they all took time, and we didn’t finish until very late," Chiu told us.

Even Daly acknowledged supervisors had few options to counter Newsom’s threats, but told us, "It’s just not the way we should be doing things."

The decision on three revenue measures (a parking tax increase, property transfer tax, and business tax reform) was set for July 27, with sources telling the Guardian that only one or perhaps two would make it onto the ballot. Newsom opposes all of them. Also hanging in the balance was Mirkarimi’s ballot measure requiring police to do more foot patrols, as well as another version in which Chiu added a provision that would invalidate the Newsom-backed ordinance banning sitting or lying on sidewalks, a retaliation for Newsom inserting a similar poison pill in his hotel tax loophole measure that would invalidate the hotel tax increase that labor put on the ballot if it gets more votes.

But most of the action was on July 20. The Transportation Authority (comprised of all 11 supervisors) voted 8-3 (with Chiu, Avalos, and Mar opposed) to place a $10 local vehicle license fee surcharge on the ballot, which would raise about $5 million a year for Muni. A Daly-proposed ballot measure to create an affordable housing fund and plan failed on 4-7 vote, with only Campos, Mar, and Chiu joining Daly.

There were some progressive victories as well. A charter amendment by Mirkarimi to allow voters to register on election day was approved 9-2, with Elsbernd and Alioto-Pier in dissent. A Chiu-proposed measure to allow non-citizens to vote in school board elections was approved 9-2, with Elsbernd and Carmen Chu voting no. And a Daly-proposed charter amendment to require the mayor to engage in public policy discussions with the board once a month was approved 6-5, opposed by Dufty, Alioto-Pier, Elsbernd, Maxwell, and Chu.

But the busy day left some progressives feeling unsettled. "How do you do this and not be trading votes?" Campos told us. "In the end, we’re saving programs, but what does it say about the institution of the board?"

Newsom spokesperson Tony Winnicker denied that the mayor made inappropriate threats, but confirmed that a deal was cut and told us, "Yes, the Mayor made his concerns about the budget clear. Yes, the mayor made his concerns about the charter amendments clear."

“Mission’s first farmers market” checks off its grocery list

I watch as Theresa Alvarez painstakingly turns four year old Rolando Steinway-Raybon into a tiger with the palette of face-paints sitting in front of the Mission Beacon neighborhood organizer. Next to them, speakers bumped a hip hop song. Down the block of Bartlett Street where they sat, community members were buying and selling bags of salad greens and edible flowers, white peaches, homemade soaps, and pupusas that came with salad and salsa for the princely sum of $2. A lot going on at the first Mission Community Market, which Alvarez takes as a good sign.

“We’re not only giving out produce, but services people might need,” she told me between happily decorated children. Alvarez’s face-painting operation had set up shop behind a table full of literature about Mission Beacon, the local organization she works for whose mission is to empower youth by exposing them to new places and skills – a bike club and a gardening class are two of the programs that the group offers out of Everett Middle School.  

The presence of neighborhood nonprofits – Dolores Community Youth Alliance and volunteers from the Mission YMCA had joined Alvarez in organizing the kids play space and were also distributing information about their programs in the hopes of attracting new volunteers – was one sign that this is a market that’s trying hard to address the needs of local residents.

The concept was first dreamed up in November of 2009 at public planning meetings for the Mission Streetscape Plan, which is re-envisioning street usage in the neighborhood. One of the market’s head organizers, Jeremy Shaw, told me its implementation followed a three point plan; “one, the farmers market, which promotes healthy eating. Number two, supporting emerging businesses, people that don’t have the capital for a storefront. Number three, community programs. We’re saying, we’re going to provide this public space and you can do what you want with it. We can use this street for more than just cars.”

True that said the crowd yesterday evening; we can use it for veggies! And for playing four square! And the strumming tunes of a mini-orchestral group! As I strolled through in the early evening hours, the block was slowly filling up with shoppers and those who had paused on their way home to see what all the commotion was about. At 5:30 p.m., volunteers at both entrances told me that they’d already counted around 330 attendees, and expected the numbers to rise as more people got off work. The market raised money for this week’s opening at a fundraiser on Bartlett Street in June, and aims to close the block between 21st and 22nd Street every week at the same time, Thursdays from 4-8 p.m.

Entrepreneurs from the Women’s Initiative hawked wares alongside the produce farmers, including Rubber Ducky Soap Co. owner Kelly Smith. Smith, who stood cheerfully behind her table stacked with naturally made bath products in a green skirt and retro cateye glasses, joined the Women’s Initiative in 2000 to gather the “networking, support groups, and knowledge” she needed to make her enterprise profitable. She recently used her business acumen to help create a new farmers market herself, in a largely abandoned strip mall parking lot in her town of Marinwood. So how were Sharp, the Streetscape Plan, and the Mission District doing on their first market day? “I have to congratulate them,” Smith told me, smiling. “They’re already so tapped into the community, that’s the basic. Its a nice honor to be a part of opening day.”

That connection gives Alvarez hope that the Mission Community Market will meet the needs of its neighborhood beyond just its shopping lists. “It’s hard when people do this without community organizations and families. In the last several years, the neighborhood’s been transforming. I think us being a partner [in the market] will help preserve what’s special about this area.”

The tax poll is seriously messed up

Chuck Nevius, who doesn’t seem to like any taxes, weighed in this morning on a poll paid for by the city’s Transportation Authority that, the way Nevius puts it, “[cast] doubt on whether it would be wise to put some tax issues on the ballot in November.” His analysis of the numbers:

His ideological soulmate over at the Ex, Ken Garcia, had a similar report. “San Francisco,” he wrote, “is not in a tax-supporting mood.”


But that’s not how I read the poll at all.


You can see the actual document here. The first thing I’ll note is that 67 percent of the people who responded were over 40. That’s not a surprise; telephone polls skew older these days. (How many young people have land lines, which are the numbers primarily called by pollsters?) The second is that some of the questions are pretty close to incomprehensible. Imagine someone reading this to you over the phone and asking for a quick answer:


To provide loans to pay for seismic retrofits of certain multi-story wood structures at significant
risk of substantial damage and collapse during a major earthquake and funded by a qualified
governmental housing finance agency for permanent or long-term affordability, or single room
occupancy buildings owned by private parties, and pay related costs, shall the City and County
of San Francisco issue up to thirty nine million one hundred forty thousand dollars of general
obligation bonded indebtedness, subject to citizen oversight and regular audits?


But the most important thing is that the tax questions were more than misleading; they’re phrased in a way that almost begs for a No. Here’s the real-estate transfer tax question:


Shall the City and County of San Francisco increase the real property transfer tax on certain
properties by between $3.75 and $10.00 per $500.00 of value, depending on the overall
property value and exempting rent-restricted affordable housing units from the increased tax rate?


That sounds like the average person trying to buy or sell a house is going to get hit with more taxes. Actually, nobody’s proposing a tax on low-end sales. If you asked the real question — should people or businesses that sell property worth more than $5 million pay a slightly higher transfer tax — you’d get a very different answer.


Here’s another one:


Shall the City and County of San Francisco establish a progressive payroll expense tax rate
structure and impose a gross receipts tax on the rental of commercial real property?


My immediate response: What the hell does that mean? It sounds like higher taxes on payrolls and a new tax on rents. Sounds like it’s bad for small business. Actually, that’s an utterly inaccurate representation of the tax the Sup. David Chiu is proposing. How avbout an honest question: Should the city cut taxes on small businesses and make banks and insurance companies pay their fair share? I suspect that would poll a little higher.

It is crucial to have high quality streets, roads and public transit, even if it means raising taxes.


A full 71 percent said they agree.

I’m not arguing that it’s going to be easy to pass any tax proposals on the fall ballot. But if you put the question the right way, and explain that these revenue measures impact primarily the wealthier residents and businesses and that they money is needed for essential public services, I think most voters are going to say Yes.



Newsom’s one bright spot (and even it’s a bit dingy)

Covering Mayor Gavin Newsom’s devious exploits for this story last week, watching as the ever-ambitious Newsom sacrificed the city’s fiscal future on the altar of political expediency and his increasingly rigid anti-tax ideology, it seemed as if there was nothing remotely redeeming about this callow, self-serving man. But then he does this, appointing Cheryl Brinkman – a strong and respected advocate for promoting alternatives to the automobile – to the Municipal Transportation Agency Board of Directors.

I’m not saying this one act redeems Newsom, not even close. In fact, some have speculated that he’s trying to coopt a qualified progressive or burnish his green credentials, an echo of the responses to when he appointed San Francisco Bicycle Coalition director Leah Shahum to the MTA board a couple years ago, a tenure Newsom ended prematurely after they clashed over creating more car-free spaces. Or maybe he’s trying to head off support for a ballot measure being considered by the Board of Supervisors to split appointments to the MTA. Who knows with this guy?

Yet it’s also true that being open to democratizing the streets of San Francisco has been a bright spot in Newsom’s otherwise dismal record as mayor. And I think that’s because the cost of admission to this movement is so low. He’s embraced temporary car-free spaces, supported more bicycling, and moved forward other green initiatives – all of which have little to no cost involved and no real political downside. So it’s been easy for Newsom to strike green poses when he chooses, just as it was easy for him to make the supposedly “courageous” decision to legalize same-sex marriage, which involved no heavy lifting and greatly improved Newsom’s political prospects.

But we’re reaching a moment of truth for San Francisco, a point at which the easy answers are evaporating and the bill is coming due – just as Newsom prepares to leave San Francisco for Sacramento. After doubling Muni fares since he became mayor and reaching a level where they really can’t go up anymore without diminishing returns and serious political consequences, Newsom and his appointees have run out of easy options for maintaining Muni in an era of declining state and federal support.

Now, the choices aren’t as easy: charge motorists more for parking, permits, or driving in the most congested times or places; cut Muni service or raise rates more; find ever more ways to nickle-and-dime everyone with various fee increases; or find more general tax revenue, which Newsom has been steadfastly unwilling to do, even though the big banks and financial services companies that caused the Great Recession are exempt from city business taxes.

Brinkman, who tells us that the Mayor’s Office placed no conditions on the appointment, now has a tough job, as do all of this city’s elected and appointed officials. But this is the moment when they must have the courage to make the tough choices about what’s best for San Francisco, choices that Newsom has been unwilling to make.

HAIRY EYEBALL “Calder to Warhol,” San Francisco Museum of Modern Art’s giant introductory survey of the Fisher collection, isn’t the only big summer show happening right now. With its wanted poster-style flyer design and a menacing title that could have come from a hardboiled paperback, “They Knew What They Wanted” is an exquisite corpse of a group show, pieced together and then strewn across town by four artists at four different galleries: Shannon Ebner at Altman Siegel, Robert Bechtle at John Berggruen, Katy Grannan at Fraenkel Gallery, and Jordan Kantor at Ratio 3.

Allusions to criminality aside, the artists/curators of “They Knew What They Wanted” would more likely be found on the forensics team than the wrong side of the law. All are steely observers whose art could broadly be said to share a focus on the dynamics of surveillance at work within postwar portrait and landscape photography, particularly photography that looked at what was booming outside of America’s urban centers. Although Grannan is the sole photographer in the group, Ebner’s temporary installations of handmade signage placed in public settings — which she then photographs in black and white — and Bechtle and Kantor’s photo-based oil paintings also fall under the sign of the photography.

It’s not surprising then that multiple pieces by each of the curators can be found across all four galleries, as well as certain names (Lee Friedlander, Miriam Böhm, Trevor Paglen, and Ed Ruscha in particular) whose work shares an aesthetic affinity with that of the curators. This form of cross-gallery display gives “They Knew What They Wanted” a cohesion that is often rare in group shows, while still not being so insular as to make it hard to differentiate each artist-curator’s own aesthetic sense.

Bechtle’s selections offer the least surprises, summoning the same post-1960s Western suburban milieu evoked by his photorealistic paintings of driveway-bound vintage cars. After a few rounds of viewing, though, Robert Adams’ vintage snaps of Colorado ‘burbs, Friedlander’s skewed takes on small town architecture, Isca Greenfield-Sanders’ aquatint etchings of backyard swimmers, and Tom McKinley’s oils of cool modernist interiors start to add up to the visual equivalent of tract housing.

Ebner and Kantor’s picks are more interior-minded than the mainly street-level and exterior scenes crowding John Berggruen. They also veer the furthest from each artist’s own work. For example, Sol LeWitt’s blink-and-you’ll-miss-it painted electrical wall plate at Altman Siegel is just a few Home Depot aisles away from Rachel Whiteread’s stainless steel castings of light switches over at Ratio 3. Back at Altman Siegel, Fletcher Benton’s 1983 bronze tennis racket, “Adjustable Racket for Short Heavy Hitters,” leans dejectedly in a corner, in wait for a yard sale that will never come. Grannan’s grab bag at Fraenkel is the most photo-heavy, and her selection ventures furthest — with mixed success — from the thematic territory staked out by Bechtle, Ebner, and Kantor.

In a way, Ebner, Bechtle, Grannan, and Kantor have beat SFMOMA to the punch. The museum is set to restage the landmark 1975 photography exhibit “New Topographics: Photographs of a Man-Altered Landscape” — which presented dispassionate documentation of parking lots, construction sites, and other forms of ex-urban development — at the end of the month. But for a sustained exploration of the meteor-like impact of “New Topographics” on the photography and painting that followed in its wake, one couldn’t ask for a better art historical crash-course than “They Knew What They Wanted.” *

Mayor Gavin Newsom and his business allies are actively trying to sabotage the various revenue measures that have been put forth by the labor movement and progressive members of the Board of Supervisors, employing deceptive rhetoric, sneaky tactics, and a refusal to bargain in good faith.

In fact, Newsom — the Democratic nominee for lieutenant governor — is so averse to supporting anything that could be called a “tax” that he rejected a hard-won compromise measure created by powerful developers, affordable housing advocates, a pro-business think tank, the building trades, and his own directors of housing and economic development.

Just as that story was breaking in the New York Times (produced by Bay Citizen) on July 9, members of the Board of Supervisors Budget and Finance Committee discovered that Newsom’s proposed ballot measure to close loopholes in the city’s hotel tax that favored airline employees and online travel companies — a widely supported change, but one worth just $6 million per year — contains language that would nullify any increases in the hotel tax. Earlier in the week, labor unions turned in signatures on an initiative to increase the hotel tax by 2 percent, which would bring in more than $30 million per year.

“This poison pill is an intentionally deceptive, underhanded move,” Gabriel Haaland, an organizer with Service Employees International Union Local 1021, which sponsored the hotel tax, told us. “It’s so frustrating. It’s not even a good faith fight. He’s trying to create confusion and fool the voters. If our measure passes fair and square, it should be implemented.”

Meanwhile, Newsom and business groups have been attacking a reform measure by Board President David Chiu that would make the currently flat payroll tax more progressive, exempt more small businesses from paying it, and create a commercial rent tax to spread the tax burden more widely than the 10 percent of businesses who now pay tax to the city.

Critics complained that the measure would hurt local businesses — but that’s just not true. The city’s Office of Economic Analysis concluded that Chiu’s original proposal would have no effect on private sector jobs and would generate $34 million annually for the city, preserving some government jobs and spending.

Then Chiu amended the measure to spare even more small businesses. Now the OEA says that the measure would actually create private sector jobs — and still bring $28 million in to the city. Yet Newsom and the business community are still withholding their support.

This trio of Machiavellian moves comes just a week after Newsom pulled out of budget negotiations with board progressives concerning about $40 million in board add-backs to programs that Newsom proposed to cut after they wouldn’t agree to his precondition that they withdraw unrelated measures proposed for the November ballot, such as splitting appointments to the Rent, Recreation and Park, and Municipal Transportation Agency boards and requiring police officers to do foot patrols.

The series of events has led many progressives to say that conservative ideological blinders — a knee-jerk opposition to anything that saves government jobs and services or that Republicans might criticize — is the only logical explanation for the intransigent stance adopted downtown and by Newsom.

“It’s ideological. It’s not economic, and it’s not even political,” said Calvin Welch, the affordable housing activist who helped negotiate the transfer tax compromise with developer Oz Erickson, San Francisco Planning Urban Research Association director Gabriel Metcalf, Mayor’s Office of Housing Director Doug Shoemaker, and others.

That measure would have created a transfer tax on sales of properties over $875,000 and generated approximately $50 million annually for affordable housing (funds that were drastically reduced in Newsom’s proposed 2010-11 budget) while cutting in half the current requirements and fees on market-rate developers to create below-market-rate units. The plan would have stimulated both types of housing and created desperately needed construction work — an approach those involved called an elegant solution to several problems.

“To me, this was a win-win, solving two problems that are each a big deal,” Metcalf told us. “I don’t know what his reasons were for not supporting it. I was surprised.”

But Welch said, “It collapsed straight up because the mayor didn’t want to support a tax.” Although Newsom told the Times it was because there wasn’t broad enough consensus yet, “the mayor’s reason is whole-cloth bullshit,” Welch said, noting the role of the Mayor’s Office in brokering the deal. “The mayor walks away from it because everyone wasn’t in the room? Well, it’s your room, motherfucker. Show some leadership.”

Newsom Press Secretary Tony Winnicker refused to discuss these issues by phone, responding to our written inquires by noting that Newsom opposes taxes and thinks the best way to address budget deficits are privatizing city services and pension reform (although he opposes Public Defender Jeff Adachi’s initiative, the only pension reform measure on the fall ballot).

“The mayor is opposed to the Board of Supervisors’ proposals to increase taxes because they’re not needed to balance the budget and they will strangle our still young economic recovery,” Winnicker wrote, refusing to answer follow-up questions or support a statement about Chiu’s measure that the OEA concludes is not accurate.

Like many political observers of all stripes, those from downtown and progressive circles, Welch criticized Newsom for his lack of engagement with city business and its long-term fiscal outlook, contrasting him with former Mayor Willie Brown, who met regularly with former Board of Supervisors President Tom Ammiano even as the two ran a bitter campaign for mayor against one another in 1999. “They dealt with the city’s business like two adults who cared about the city,” he said.

Welch acknowledged that there was still work to be done building political support for the transfer tax measure. He and other progressives would have had to win over city employee unions who wouldn’t like the budget set-aside aspect, and Erickson and Metcalf would need to placate some of their downtown allies who oppose taxes on ideological grounds. But given how downtown groups are behaving right now, that might not have been an easy sell.

“There are members of the small business community that are averse to any taxes,” said Regina Dick-Endrizzi, director of the city’s Office of Small Business and staffer to the Small Business Commission, which was withholding a recommendation on the Chiu measure but planned to meet again to consider it July 12 (look for an update on the sfbg.com Politics blog). She said the small business community is having tough times and “they are just not sensitive to keeping city workers employed.”

Larger commercial interests are being even more forceful in opposing the revenue measures. While a parade of workers, social service providers, and progressive activists testifying at the July 9 Budget Committee hearing implored supervisors to place all the proposed revenue measures on the ballot, representatives from the Building Owners and Managers Association (BOMA) and San Francisco Chamber of Commerce were the only two speakers urging supervisors to drop the measures and focus instead on creating private sector jobs.

“You’re trying to create a little revenue here and it’s not going to work,” said Ken Cleaveland, director of BOMA SF, arguing that big banks and financial services companies — entities exempt from the payroll tax that Chiu is hoping to target with the commercial rent tax — will buy their buildings to avoid paying the tax. “They aren’t going to create more jobs and they really aren’t going to create more revenue.”

Yet Chiu noted that it was the business community and fiscal conservatives who pushed to create the Office of Economic Analysis, whose work they have regularly used to attack progressive legislation. Now that the office has concluded that a piece of progressive legislation is good for the local economy, Chiu told Cleaveland and the Chamber spokesperson Rob Black at the hearing, “I ask you to respect the work this office has done.”

Black said the Chamber board will consider Chiu’s amended legislation, but said businesses are in no mood to help the city. “How many times have you gone to your neighborhood merchant and had them say, ‘Gee, my rent’s too cheap’?<0x2009>” he said during his testimony.

Yet Chiu said landlords of small tenants (those paying less than $65,000 in rent per year) are exempt from the rent tax and only 26 percent of SF businesses would pay any city business tax under his plan. “I hope the mayor will support this proposal and the business community will give it a good look,” Chiu said as the hearing ended.

At the beginning of the hearing, Chiu framed the dire situation facing San Francisco, citing Controller’s Office figures showing this year’s $500 million budget deficit (out of a $6 billion total budget) will be followed by a $700 million deficit next year and a $800 million gap the following budget cycle as a result of a deep structural budget imbalance.

“We have budget deficits as far as the eye can see,” Chiu said at the hearing. “We have to consider measures that will provide more stable sources of revenue.”

He also noted that city employee unions have agreed to give back about $250 million in salary and had their ranks reduced by about 2,000 workers in the last two years. So he and the other progressive supervisors say it’s time for the rest of San Francisco to help address the problem.

“We, as a city, should not be trying to balance this budget simply through cutting,” Sup. David Campos said.

Sup. John Avalos, the committee chair, amended his transfer tax measure in the wake of Newsom’s rejection of the deal by making it a simple 2 percent tax on properties that sell for more than $5 million, and 2.5 percent tax on properties over $10 million. He estimates it will bring in about $25 million per year from the city’s wealthiest corporations and landlords.

“That’s who we’re socking it to,” Avalos told us, saying he was disappointed the compromise fell through. “The amendment is going to be more progressive than what was originally planned.”

Even Sup. Sean Elsbernd, a strong fiscal conservative who announced early in the hearing, “You want to do that [balance future budgets] by adding taxes, but I want to do it through ongoing service cuts,” later told the Guardian that he was intrigued by the amendments Avalos and Chiu made to their measures and has not yet taken a position on them.

Sup. Ross Mirkarimi is also sponsoring a measure to increase the city’s tax on parking lot operators from 25 percent to 35 percent, the first change to that tax in 30 years, and will include valet parking for the first time. The measure would bring in up to $24 million per year, and OEA analysis shows it would decrease the number of cars trips by 1.3 percent, another benefit.

SFMTA supports the measure, with board member Cameron Beach testifying that the money will be used to subsidize Muni and “it links the use of private automobiles and is consistent with the city’s transit-first policy.” Mirkarimi, who chairs the Transportation Authority, also has proposed a $10 local vehicle license fee surcharge that would bring in another $5 million per year for Muni.

All the revenue measures require six votes by the full Board of Supervisors, which is scheduled to consider them July 20, after which they would need a simple majority approval by voters in November to take effect.

The mayor has the authority to directly place measures on the ballot, so the committee hearing on his hotel tax loophole measure and a $39 million general obligation bond that he’s proposing to create a revolving loan fund for private sector seismic improvements were mere formalities, so supervisors criticized aspects of each but were unable to make changes.

Avalos even grudgingly acknowledged the hotel tax poison pill was an effective way to kill that revenue source, saying at the hearing, “This is very smart. I don’t agree with it, but it’s very smart.”

Haaland was less charitable, criticizing a provision designed to confuse voters. “This kind of move means both measures won’t pass because now we have to oppose [Newsom’s measure],” he said, criticizing the mayor for running away from the hard decisions facing the city. “He won’t be around next year, when we have an even bigger structural budget deficit, to clean up this mess. Absent new revenue sources, this city starts to fall apart.”

Sunday Streets creates public benefits from private labors

San Francisco locals will take to the streets this weekend as main roads in the Mission neighborhood are closed to automobiles for the sixth installment of Sunday Streets. On July 11, a three-mile route from 17th and Valencia to Dolores Park to Potrero Avenue will be car-free from 10 am until 3pm.

Taken from Bogota’s weekly ciclovía, in which nearly 100 miles of city streets are reserved for pedestrians and other recreationalists, Sunday Streets began in San Francisco almost two years ago. Since then, the tradition has made its way to other California cities including Los Angeles and Oakland.

“In San Francisco we have our own unique style,” event coordinator Susan King, who works for the nonprofit group Livable City, said. “We have different routes and we hit different neighborhoods year after year. In each neighborhood, the featured events have their own flair.”

This Sunday, revelers can look forward to performances by Grupo Azteca as well as capoeira and salsa dancing lessons, not to mention the countless restaurants in the area opening their doors early to the public. While the event has some support from the city and its San Francisco Municipal Transportation Agency, mostly in the form of permit fee waivers, it is run by Livable City and funded from corporate donations.

“Our corporate sponsors provide everything from durable goods, in-kind donations and cold, hard cash,” King said.

City officials have even curtailed helping with hanging “no parking” signs, leaving that task to volunteers from the SF Bicycle Coalition. That job was usually designated to the San Francisco Department of Parking and Traffic, but they have now stopped providing that service to an event that Mayor Gavin Newsom trumpets as something he’s bringing to the people. But King still calls Sunday Streets a good example of a public-private partnership.

“Everybody brings something to the table,” King said. “It’s a real cooperative entity with everyone pulling together to produce something really special.”

According to King, the benefits are widespread. Not only is it refreshing for the public to ditch their cars for a few hours, but it also reinvigorates the local economy. “It’s a real boom for the city,” King said. “Lots of people on the street means lots of eating. It’s good for business and good for the community.”

Acting executive director for the SF Bicycle Coalition Renee Rivera said that the Mission in particular has benefited from the crowds at Sunday Streets. “Everyone is enjoying the outdoor activities the event has to offer but, at the same time, are going to get ice cream, stopping for tacos or getting to enjoy all the merchants on 24th and Valencia,” Rivera said.

There are three more Sunday Street events following the Mission neighborhood closure. The Great Highway and areas of Golden Gate Park will be closed on August 22 followed by the Western Addition on September 19. The series will conclude on October 24 with the closure of the Civic Center and Tenderloin areas.
