Careers and Ed: A life of death

A kid gets killed in the cross fire of a shooting. Someone digs up a human skull while planting begonias. An elderly woman dies in her sleep in an apartment no one has visited in years.

In all these cases, somebody — or somebodies — has to examine the scene and, well, the bodies to find out what happened. And as any fan of hard-boiled detective stories, CSI, or Quincy, M.E. knows, those somebodies are the forensic team, perhaps most prominently the coroner.

It’s a mysterious job with macabre connotations, imbued with a mix of excitement and dread. A new show on Spike purports to show armchair detectives what it’s really like, with Grand Guignol bravado, but I always wonder, is that really how it is? So I decided to find out.

GOING DOWNTOWN


I start with our own fair city of night, only to discover that the subject of coroners is more complicated than I thought. What TV often portrays as one or two jobs is often many different jobs. And San Francisco County doesn’t have a coroner — a position defined as an elected or appointed government official who deals with deaths that raise questions. Instead, it has a medical examiner, whose office is headed by an MD or doctor of osteopathy. The difference may seem like semantics, but it’s an important distinction for people in the field.

I also learn that it will be next to impossible to meet San Francisco’s medical examiner, Dr. Amy Hart. Unlike her predecessor, Dr. Boyd Stephens — whose media accessibility and subsequent scrutiny led to controversies about the reuse of needles, improper ventilation against dangerous pathogens in autopsy rooms, misappropriation of funds, and sexual harassment — Hart is fairly shy when it comes to the media. Public controversy can be a downside to the job, whether it’s over the contested findings of Los Angeles’ fabled "coroner to the stars" or the unpopular study by Marin County’s coroner of suicides on the Golden Gate Bridge.

So I get the basics about the job from Hart’s deputy administrative director, Stephen Gelman, at the ’50s-era Medical Examiner’s Office on the grounds of the Hall of Justice. Gelman, a middle-aged, white-haired former special agent with the Department of the Treasury, explains the makeup of the office: 32 people, including forensic pathologists and anthropologists, toxicologists, chemists, investigators, and administrative personnel.

And becoming part of Hart’s team isn’t easy, especially since forensic-themed TV shows and the office’s involvement with UC San Francisco managed to attract 160 applicants during a recent call for three positions. Preference is given to those with a background in medicine and, at the very least, the funeral industry.

"IT’S CHINATOWN …"


But those are just the facts. My experience at the Alameda County Coroner’s Bureau, an art deco, cream-colored building on the outskirts of Chinatown, is much more visceral.

Inside I meet the genial Lt. Jason Arone, who explains that the bureau has been under the jurisdiction of the Alameda County Sheriff’s Office since 1989. That gives Sheriff Gregory Ahern the title of chief coroner, but on a day-to-day basis, Arone is the guy in charge. I also meet Mike Yost, a former detective who is now a public administrator, which means he handles the belongings of decedents, from pets to hidden stashes of money.

Downstairs, the morgue is pretty much what movies would have you expect: cold metal and antiseptic green tile. Arone pauses at the sound of a saw — we can’t go inside if there’s an autopsy under way. But it’s just carpenters fixing a door. Inside, I’m struck by the lack of sliding-drawer coolers — bodies are identified by photograph these days and are kept in less-obvious storage rooms.

Then I meet autopsy technician Smiley Anderson — sometimes referred to as "the bullet finder" by resident pathologists. The 25-year veteran started working in his family’s mortuary as young man in the South — much the way many in coroner’s offices got their start. But Anderson says the field is changing now. Crossover careers are rarer, and he says the best way to get in is through an education in medicine.

As I sit at his desk outside the autopsy room, I notice what Arone calls "the meat-locker smell." It’s neither the smell of embalming fluid that I associate with funerals nor that of decay — just a stale, permeating reminder of what’s inside.

OUT IN THE FIELD


It’s midafternoon when I meet Alameda County Coroner’s Bureau detective Eric Larson, who’s agreed to show me the other side of the job: going out on calls. I wait with the jocular thirtysomething until two calls come in.

One is a follow-up from the night before. A young girl and her brother were at the house of a family friend, which also serves as a rehabilitation facility; soon after dinner both fell ill. The brother recovered, but the young girl died. Larson decides to ask some questions, though the toxicology report is still pending.

The other call is a notification about a suicide on the Golden Gate Bridge. (Sometimes Alameda County representatives will handle calls for Marin County if the next of kin is in the East Bay.)

Larson puts on his flak jacket as part of his routine, and we get into one of the department’s cars. Since it’s not a pickup, he says, we won’t need one of the vans.

The first stop is at a sagging west Oakland house. The man who answers the door is barely coherent but sends us to Children’s Hospital. When we get there, I’m amazed to see the little boy we got the call about bouncing up and down, chewing on a french fry. When he sees Larson, he starts singing, "Bad boys, bad boys …" Larson laughs and says, "That’s my favorite song, buddy." The child’s hale liveliness is heartbreaking with the knowledge I have of his sister.

Larson asks the family friend, who’s at the hospital, for any information on the night before. It’s unclear whether he’ll get answers, and he tells me that sometimes he never does. In fact, that’s one of the hardest parts of the job. "It doesn’t matter how much science you throw at it," he says. "Sometimes it comes out undetermined."

It’s getting late as we head to the home of the suicide victim’s sister in Castro Valley. No one answers the door. Larson checks with the Marin County Coroner’s Office for another address, then stops by a dispatch office to get directions. Notification is important to Larson, as people may otherwise never hear about the fates of their loved ones.

We arrive in a quiet, ’70s-era housing tract in San Leandro, at the house of the victim’s mother. Again, no one is home, but a neighbor with emergency keys checks the house, determining that the victim’s mother has gone for a walk with her dogs. We wait at the house.

When she arrives, she knows what Larson’s going to say before he opens his mouth — but the news is no less brutal. When we leave, her neighbors are sitting beside her on the couch, friends from happier, simpler times.

It’s late when we return to the office, and Larson is supposed to work another swing shift tomorrow. But he gets a message from home. The son of a friend died in an accident. The funeral is tomorrow.*

It didn’t matter how soon paramedics arrived. Kevin Noah, a 42-year-old carpenter with three sons, had no chance. The accidental 50-foot plunge from his perch on the Golden Gate Bridge killed him immediately.

Noah’s dizzyingly high station was a mere cross section of rebar — the slender iron braids that are often seen protruding from construction sites and provide a structure with skeletal support — inside an anchorage house located on a landbound portion of the bridge’s southern end.

Moments before on that August 2002 morning, Noah had been performing his normal duties, receiving planks of wood from another worker for use in forming a temporary frame to contain a wall of fresh concrete. The bridge was a year into phase two of its multimillion-dollar retrofit, which today is nearly complete.

Suddenly, the clip on Noah’s brace slid off the edge of an open-ended piece of rebar, and a nearby worker looked up just in time to see Noah’s body collide with the extended boom of an industrial cherry picker before falling the rest of the way to the ground, according to an account in public workplace-safety records.

In February 2003, Cal/OSHA, of California’s Division of Occupational Safety and Health, concluded its investigation and penalized the retrofit’s prime contractor, joint venture Shimmick-Obayashi, for, among other things, allegedly failing to properly rig Noah’s fall protection and not providing workers with scaffolding to stand on in construction areas where the footing was less than 20 inches wide. Fines for the violations — three of them designated by the agency as serious — totaled more than $26,000.

But Shimmick-Obayashi wouldn’t pay a dime.

The outfit immediately turned to the Cal/OSHA Appeals Board, and since such cases are backlogged statewide, the matter didn’t reach an administrative judge until this year, when attorneys for Shimmick-Obayashi presented a peculiar defense. Cal/OSHA, they argued, sent the company citations through the mail that failed to list the full legal name of the company: the mailings were addressed to Shimmick-Obayashi instead of Shimmick Construction Company, Inc./Obayashi Corporation, Joint Venture.

The misstatement was akin to a cop failing to note "Esq." or "Jr." on a parking ticket. Cal/OSHA pleaded with the judge, Barbara Steinhardt-Carter, that "it is against civil law, board precedent, and public policy to dismiss this matter based on a minor technical fault that misled no one and caused no prejudice."

Steinhardt-Carter, however, bought the company’s claim and ruled earlier this year that Shimmick-Obayashi was liable for none of the fines, even though Cal/OSHA got the name it used from the company’s business cards.

Throughout a three-year period during which the parties exchanged memos, motions, and discovery material, the contractor’s lawyers never mentioned a problem with the original citations, Cal/OSHA spokesperson Dean Fryer told the Guardian, and variations of the name Shimmick-Obayashi appear on several court documents. The move was a last-minute Hail Mary by a cunning industry lawyer who represents several major players in the business. And it worked.

"The outcome of this case is really surprising and disappointing to our staff," Fryer said. "They went through a long and thorough investigative process, and their work is now basically disposed of."

That Shimmick-Obayashi attorney, Robert D. Peterson, knows more about workplace-safety laws than most. He literally wrote the Cal/OSHA handbook commonly used by employers today and served as chief counsel to the appeals board until 1978. That’s when he established his own law firm and began representing large-scale employers in occupational-safety and workers’ compensation proceedings.

"The bottom line is, if the division has a responsibility to identify correctly the employer that it’s alleging created a violation of a safety order [and] it doesn’t do that, then the citation won’t stand the light of day," Peterson told the Guardian. "Apparently, they didn’t do that. It’s a pretty simple thing to do."

Mammoth civil engineering concerns commonly form temporary partnerships, as several have done to bid on the half-dozen Bay Area bridge retrofit projects initiated by the state at a cost of billions of dollars since the Loma Prieta earthquake rattled the coastline in 1989.

Shimmick-Obayashi won its $122 million phase two contract in 2001 to replace the Golden Gate Bridge’s steel support towers and reinforce its pylons. That came after phase one more than doubled in cost to $71 million by the time it was completed that year under another contractor. All told, Shimmick-Obayashi will earn more than $150 million following a series of change orders, a spokesperson for the bridge agency told us.

The joint venture’s initial bid beat out those of four other firms, including the politically well-connected Tutor-Saliba Corp., which later earned $760 million in a partnership with two other companies to reinforce the Richmond–<\d>San Rafael Bridge. We’ve previously reported on the dozens of injuries and the three deaths that have occurred during that project (see "Lessons from the Bridge," 11/14/06).

Obayashi on its own has had a string of run-ins with Cal/OSHA in recent years. Last March regulators hit its local housing construction subsidiary with $27,000 in fines for allegedly failing to maintain proper railings at a site in downtown Oakland, according to a federal Occupational Safety and Health Administration database analysis. The company is currently fighting those penalties. In February it was fined $6,400 for an alleged lack of railings at a project in the Bayview. Overall, the company has $60,475 in statewide open Cal/OSHA penalty cases dating to 2005.

Shimmick’s cases are few since 2000, but in the middle of last year, Cal/OSHA issued the firm two serious citations totaling $36,000 in fines after an aerial lift carrying an ironworker reportedly fell off a 34-inch light-rail platform during construction of the Muni’s T Third line, "ejecting the employee into the fast lane of traffic." The 52-year-old man was taken to San Francisco General Hospital with a serious skull fracture. A safety director for Shimmick, Ike Riser, argued that despite the accident, Shimmick has one of the best safety programs in the state.

The incentive to keep even small settlements from blemishing a safety record is huge for contractors because they can lead to the escalation of insurance rates and make bidders less competitive. Cal/OSHA’s Fryer said that while Shimmick and Obayashi have faced serious recent incidents, together they have had relatively few problems on the Golden Gate Bridge.

"It doesn’t appear with the joint venture that there is really a pattern of concern," he said. "It’s just that this specific incident resulted in the fatality of a worker, when it could have been prevented."

Noah’s mother, Sandra, told us that her son began doing carpentry at age 16 and always preferred working on big jobs. She was unaware of the ruling until we reached her, long after Cal/OSHA first cited the contractor, but she believes Shimmick-Obayashi deserved the penalties.

"To leave three sons behind," she said, "that’s the real tragedy."<\!s>*

Who’s behind the wheel?

In 1997, Dirk, a taxi driver of 20 years, was stabbed in the neck by a hitchhiker he picked up after his last shift. Ten years later, blind and brain damaged because of the loss of blood, he still receives income of roughly $1,800 a month from his taxi medallion.

Under city law, he’s supposed to be driving.

Medallions are among the most prized — and disputed — permits in town. The city owns all 1,381 of the medallions, which allow the holders to operate taxis. But under a 1978 law known as Proposition K, only active drivers — later defined as people who put in an annual minimum of 800 hours behind the wheel — are eligible to hold the permits.

The medallion holders have a lucrative deal: when they aren’t driving, they can lease out the permits to other drivers. And since a lot of cabs are on the road 24 hours a day 365 days a year, those lease fees can add up.

Not surprisingly, there’s been some abuse over the years. You get a permit by putting your name on a list and waiting as long as 15 years. Some people who haven’t driven in years — people who don’t even live in the area — have risen to the top of the list, seized medallions, and pocketed the cash, hoping nobody would notice.

Recently, though, the city’s Taxicab Commission has been cracking down — and that has put people like Dirk in limbo and raised a series of political and legal questions that go to the heart of the city’s cab-permit system:

Does a disabled driver have a right to keep his or her medallion? Is it cruel to simply yank the permit — and the income — from somebody who may have been injured in the line of work? Or is allowing nondrivers to keep their medallions unfair to the thousands of working cabbies who are paying $91.50 a shift to lease a permitted cab and waiting in line for a permit to open up?

What right should someone who gets a valuable city permit, at no cost, have to keep using that permit to earn income when he or she no longer meets the permit requirements?

Taxicab Commission executive director Heidi Machen says the answers are straightforward. "Permit holders who are not meeting their requirements are abusing a public permit," she told the Guardian. "Proposition K was never set up as a retirement plan."

Joe Breall and Elliot Myles disagree — and they’re taking the issue to court in a case that could have lasting implications for the city’s taxicab industry, medallion holders, and other drivers.

The two Bay Area lawyers filed a class action lawsuit against the Taxicab Commission on June 25 on behalf of an estimated 150 disabled drivers who hold taxi medallions in the city. They argue that the driving requirement violates the 1990 Americans with Disabilities Act.

"These are long-term drivers who have a disability that simply does not allow them to drive now," said Breall, who represents National Cab Co.

One of the case’s two named plaintiffs, William Slone, is a medallion holder with a lung disease that requires him to be hooked up to an oxygen tank 24 hours a day. The other, Michael Merrithew, has a physical disability so severe that he cannot operate his taxi.

Machen has hired two investigators to crack down on medallion holders who are not fulfilling their requirements — whether a scofflaw is a healthy 30-year-old woman living in Hawaii but reaping her medallion’s profits or an elderly man who must use a wheelchair but is still using the medallion as his source of income.

"The ADA does not require a public agency to waive an essential eligibility requirement for a government program or benefit," Machen wrote in a memo dated Feb. 16, 2006.

The Taxicab Commission isn’t just yanking permits from anyone who gets hurt. Under its current policy, temporarily disabled medallion holders can apply to take one year off every five years and receive a 120-day driving exemption in each of the three years following that disability leave.

But the lawsuit argues that this policy "effectively sanctions all taxicab permit/medallion holders with disabilities other than temporary illness that prevent or substantially limit their ability to drive taxi cabs personally."

The lawsuit argues that disabled permit holders, under the ADA, should be relieved of the full-time driving requirement until their disabilities are medically resolved. In the case of some drivers, that could effectively give them use of city-owned medallions free, for life.

TRICKY ENFORCEMENT


Prop. K was written by recently retired San Mateo Superior Court judge Quentin Kopp, who was then a city supervisor. Kopp told us that permits were being bought and sold for hundreds of thousands of dollars and working drivers couldn’t afford them. The system, which is fairly unusual, was designed to ensure that cabbies — not investors, corporations, or speculators — got the benefits of the city-owned permits.

So Prop. K required that a permit be returned to city and passed on to the next person on the long waiting list if the holder stops driving. Other large cities, such as New York, still maintain a system in which permits may be auctioned off instead of being publicly owned.

The 941 post–<\d>Prop. K medallion holders, Machen said, can receive $1,800 to $3,000 a month for leasing their permits. There are roughly 6,000 taxi drivers in the city; a full-time cab driver makes about $24,000 a year, but those full-timers with permits can add another $20,000 or more to their income by leasing.

"It’s a city permit. If someone stops using it, it reverts to the city," Kopp told us. "There’s no provision for a grace period or something of that sort. Seven times voters rejected efforts to appeal or change it."

In fact, in 2003 voters overwhelmingly rejected a measure that would have allowed disabled drivers to keep their permits.

Elliott Myles of Oakland’s Myles Law Firm, which handles disability cases, told us that Prop. K is "irrelevant."

"The obligation to modify or waive comes from the ADA, a federal law binding on the commission," he wrote in an e-mail.

Although Kopp says Prop. K was intended to ensure that only active drivers get permits, the 800-hours-a-year rule isn’t in the law. Specific driving rules were added to the city’s Police Code in 1988.

And enforcement of the law has changed in the past few years. When the Taxicab Commission revoked the medallion of disabled driver Querida Mia Rivera in 2003, the decision was overturned by the Board of Appeals on the grounds that it violated the rights of Rivera — who had driven for 35 years before needing a wheelchair and becoming legally blind — under the ADA.

In response to the reversal, then-director Naomi Little implemented a policy to accommodate both temporarily and permanently disabled medallion holders, which paralleled the city’s catastrophic-injury program. This meant the modification or waiver of the 800 hours was overseen by the Department of Public Health.

"A disabled permit holder may apply for a waiver or reduction of the driving requirement, and the waiver or reduction, in appropriate cases, may be renewed on a yearly basis," Little wrote in a memorandum to Sup. Jake McGoldrick on July 30, 2003.

But in February 2006 the Taxicab Commission adopted Resolution 2006-28, which returned the city to the policy of strictly following the letter of Prop. K (although the panel allows temporary reprieves for people who are injured but could return to driving).

Michael Kwok, a former commission staffer who oversaw disability requests, said such a policy allows the permit waiting line to move faster.

Allowing a permanently disabled person to retain his or her permit is "not fair to the public," said Kwok, who uses a wheelchair. "It’s case by case."

The result is an enforcement process that can be tricky, to say the least.

On Aug. 17, 2004, for example, a physician wrote to the commission arguing that a disabled driver who was "suffering from failing eyesight and dizziness" and occasional arthritis in his hands should be taken off the road. "Please release him from taxi driving effective immediately for public safety," the doctor wrote. "He is advised not to drive a taxi as soon as possible."

Commission staffer Tristan Bettencourt, who was overseeing ADA compliance at the time, responded by reducing the driver’s yearly driving requirement to 400 hours, or 78 four-hour shifts, over the next year.

That could have left an unsafe driver on the road, Myles said.

"I find this reprehensible," he told us. "In most medical-injury suits, evidence of medical condition can only be given by qualified health care professionals."

Bettencourt, who left his job last year, said the Taxicab Commission shouldn’t be deciding whether someone is fit to drive or not. "We didn’t give out driver’s licenses," he told us. "If you hold a driver’s license, someone from the Department of Motor Vehicles has certified you."

According to Jan Mendoza, a public information officer at the DMV, a license needs to be renewed every five years — a process that can take place online if a person has a clean record. People over the age of 70, however, have to visit the office in person to take both a vision and a driving test.

Taxi drivers should not have any guarantee of lifetime entitlement, Bettencourt said. He added that the lack of a safety net for people who lose their means of employment is not something a San Francisco taxi regulator can solve; it’s a national problem.

EXIT STRATEGY?


Thomas George-Williams, who chairs the United Taxicab Workers, looks at the issue from the perspective of drivers who don’t have permits — the ones he considers second-class citizens in a two-tier system.

All San Francisco cab drivers are effectively independent contractors who are responsible for their own disability and retirement funds. And the drivers who don’t have permits get no benefits from the system at all.

Medallion holders "use the income of their medallions for disability insurance," George-Williams told us. "We need an exit strategy for all drivers, including medallion holders, and we don’t have that."

Charles Rathbone, a driver for 30 years and a medallion holder for 10, points to the harsh truth: there’s a key difference between the two cabbie classifications. "For drivers without medallions, there’s nothing to revoke," he told us.

Rathbone, a member of the Medallion Holders Association, spoke at the Taxicab Commission meeting July 13 to lay out two steps he felt the city should take before revoking a permit. He asked for two weeks’ advance warning and an appeals process.

"When I become disabled, I don’t want my only exit strategy to be a kick in the ass from the taxi commission," Rathbone later told us.

His speech was spurred by the June suicide of Lindsey Welcome, a 61-year-old medallion holder of 10 years who had not driven for seven of those years due to severe muscular dystrophy. Welcome’s medallion, which she leased out through Luxor Cabs, was scheduled to be revoked at the Taxicab Commission’s June 26 meeting.

"Her medallion was her only means of support," Kathleen Young, Welcome’s friend of 30 years, told us.

Rathbone feels many disabled medallion holders hide their disabilities for fear of the consequences, endangering themselves and the public.

One of the more severe recent taxi incidents happened March 26, 2003, when a 68-year-old permit holder crashed into a Market Street ATM, badly injuring a pedestrian and immobilizing two others.

"Too many people are driving when they shouldn’t be," said Bettina Cohen, Rathbone’s wife and editor of the MHA newsletter, which publicized the pending disability lawsuit on its front page last month.

Allowing disabled drivers to keep their permits may have its own downside: Carl Macmurdo, president of the MHA, acknowledged that the long waiting line for medallions means people will acquire them later in life and so will often be able to fully enjoy them for only a short time.

"[The city’s] giving permits to 70-year-olds and then taking them back," Macmurdo, who waited 13 years to get his permit, said.

Myles shared similar sentiments. "Every permit holder, just like every person, runs the risk of disability," he told us. "This question [of the disabled holding on to their permits] affects not only every current permit holder but every driver who is waiting in line to get a permit in the future."<\!s>*

One of the most exciting aspects of being a newspaper editor is recognizing a wave of activity that isn’t connected to government mind control or onslaughts of corporate-sponsored and mass-marketed art. This kind of spontaneous mass energy is happening via photography in San Francisco right now. August is known as a slow month, but the city’s galleries are alive with contemporary photos. Bill Daniel’s latest look at the US landscape is opening at RayKo Photo Center, the Daniel-influenced vagabond spirit Polaroid Kidd has his first Bay Area show at Needles and Pens, Greg Halpern’s moody views of Buffalo and Kelli Connell’s double-minted prints are up at SF Camerawork, and at City Hall — through the San Francisco Arts Commission Gallery — the work of 32 local photographers is on view.

Baptized in arguments regarding its viability as an art form, photography remains as contentious as it is expansive. Witness a veteran such as Duane Michals sharpening his claws on the megapopular likes of Cindy Sherman in last year’s rant-monograph Foto Follies: How Photography Lost Its Virginity on the Way to the Bank (Thames and Hudson). We live in an era when the ready availability of portraiture seems to have made its definition even more reductive; via MySpace and more explicit sites, people use cameras to readily package themselves as products. Yet when black-and-white and color and digital and film collide with unpredictable results, photo portraiture can be as varied and lively as the work you’ll find on these pages.

Thanks to fellow Guardian arts editor Kimberly Chun for suggesting, late in the selection process, a focus on portraiture. This decision necessarily narrowed the Bay Area photographers to choose from; there’s a wave of garden- and eco-driven work being done by Bill Basquin and others, while Dusty Lombardo, R.A. McBride, and Jackson Patterson are discovering tremendous depth in interiors. Thanks also to Basquin, Daniel, Glen Helfand, Chuck Mobley, Katie Kurtz, and Dave and Ray Potes for their suggestions.

Twelve years ago I interviewed therapist and author Walt Odets because he was bringing much-needed humanity to discussions of the AIDS crisis; to find out that he’s also a superb photographer whose subjects have included Jean Renoir and his wife, Dido, is a revelation. In distinctive ways, Vic Blue, Robert Gumpert, and Amanda Herman reveal what journalism usually ignores or renders shallow. The intimacy of Vala Cliffton’s photos makes one ponder her presence within the scenes she depicts. Matthias Geiger shows a city you might not have noticed even when it’s been in front of your face. Stan Banos has an eye for the many shades of gray within the multihued and the cuckoo. Job Piston is that rare Bay Area photographer whose work brandishes a sexual edge that isn’t obvious or predictable. Jim Goldberg’s urban work has been canonically influential since the publication of Rich and Poor (Random House, 1985) and Raised by Wolves (Scalo, 1995). Photography is just one aspect of Désirée Arlette Holman’s hand-fashioned fantasy world, a place that looks like a wicked satire of our own.

Herman met the Morris family in Oakland while doing free family portraits for survivors at a relief day in October 2005, one month after Katrina drove them from their homes, and, she writes, "over time, I became interested in exploring the intricacies of one family’s experience with the disaster." Donations and income from the sale of the Lost Island DVD will go into a family fund to assist the Morrises as they rebuild their lives in Oakland.

Something Ain’t Right was inspired by smoking chimps in zoos in South Africa and China. One zookeeper claimed that the chimps were smoking because they are frustrated. Could captivity make a chimp neurotic and lead it to smoke? Others claimed that the chimps were imitating tourists, recalling the cliché ‘Monkey see, monkey do.’ "

The ugly news we’ve been waiting to hear

Alas. Alas. As predicted by the Guardian, the Bruce blog, and most everybody in and around the Dean Singleton news operations, the bad news was flashed this morning by my reliable source in Contra Costa County in his note and Singleton story below.

This was a major story on yet more news consolidation in the Bay Area, but it only rated a three paragraph burial story on page 2 of the daily digest page of the business section of Singleton’s only Bay Area daily “competitor,” the San Francisco Chronicle.

Its lively head says, “Chain consolidates newsroom operations,” which means in effect “please don’t read this story, it is damn boring.” Its boiler plate press release coverage says without blushing: “The consolidation of the papers, all owned by MediaNews Group (B3: Singleton) will result in job cuts as part of an effort to eliminate redundant positions, beef up online coverage and save money…The company said that it hopes attribution will cover the staff reductions, but added that layoffs may be necessary…Local news reporting will continue to be supervised by editors at each of the newspapers…” Wow, now that is real enterprise business reporting!

My source wrote by email:

“The following appears today in the business pages of at least the CCTimes and Oakland Trib. Times ran it below fold on pg. 1 of business section; Trib ran on an inside business page.

“I still have the image of Singleton standing in the city room of the Times at the time of the sale, saying staff and editorial direction for the various papers would remain in place. Hah. It won’t be long before there is but one newspaper to serve the East Bay, perhaps with zoned editions that are community specific.” (B3: my source, a veteran newsman who has lived in the county for years, has yet to be wrong on any of his predictions.)

East Bay newspapers plan to consolidate news operations
Owner of Times says move will improve coverage, efficiency

The company that owns the Times said it will consolidate the news operations of several East Bay newspapers as a way to improve coverage of the region and create a more efficient organization.
Starting Aug. 13, all employees of the East Bay papers affected will work under the umbrella of Bay Area News Group-East Bay, said John Armstrong, vice president of California Newspapers Partnership, which owns the publications.
“We are making this change, which integrates three entities into a single operation, to allow us to maximize our East Bay news-gathering capabilities,” said Armstrong, publisher of the Times.
The daily newspapers affected by the consolidation are the Contra Costa Times, Oakland Tribune, Tri-Valley Herald, Valley Times, San Ramon Valley Times, East County Times, West County Times, Hayward Daily Review, San Joaquin Herald, Fremont Argus and San Mateo County Times. A number of nondaily papers are also included.
The reorganization will “eliminate wasteful redundancies, streamline management and redirect staff and resources to our interactive services and other priorities, such as watchdog journalism,” Armstrong said in a memo he sent to employees of the newspapers.
Job cuts could materialize as a result of the consolidation.
“As we eliminate duplication of effort in our newsrooms, we will reduce the size of the editorial staff,” Armstrong stated. “It is our hope attrition will cover this reduction, but there is no guarantee that layoffs can be avoided.”
The combined newsrooms now have about 360 employees, said Kevin Keane, executive editor of the Times and vice president for news of the regional news group. Keane will become executive editor of Bay Area News Group-East Bay. Pete Wevurski, who had been editor of ANG Newspapers, will become managing editor of the new editorial organization, reporting to Keane.
The changes come as newspapers nationwide must wrestle with defections of advertisers and readers to the Internet.
“We need to start thinking of ourselves as information companies and not just as newspaper companies,” Keane said.
He said he believes the emerging news organization in the East Bay can deploy reporters and other news employees in a way to help the newspapers embrace a fast-changing digital world.
“We can put content online virtually 24 hours a day, seven days a week,” Keane said. “We can break news online around the clock.”
Although the restructuring of the news industry has brought about painful changes and may continue to do so, Keane suggested the changes also can bring plenty of upside.
“There are a lot of challenges in the newspaper business with advertising drifting away to the Internet,” Keane said. “There is also a lot of opportunity to do things in new ways. The challenge for us is to find a balance between our reader demands for online content with our core print business.”

Watchdog journalism? C’mon. For starters, the Singleton papers will be covering even fewer night meetings of the local city councils, planning commissions, school and community college boards, and other government agencies in the East Bay and Singletonland. And they sure as hell won’t be covering the news or selling ads in a competitive newspaper environment. Alas. Alas. B3, ever more annoyed to find that newspapers, even as monopolies, continue to do such a lousy job of covering the biggest local story on their turf (themselves)

No waterfront highrises

EDITORIAL We’ve been concerned for decades about development along San Francisco’s waterfront, and with good reason: the Port of San Francisco has done a generally miserable job of managing one of the city’s most significant resources. In the 1960s and 1970s, the port effectively gave up on the shipping industry, losing container freight (and plenty of good blue-collar jobs) to Oakland. Development proposals for port property, particularly under then-mayor Willie Brown’s administration, were largely horrible.

And now the port wants the state to turn over development rights for some key seawall-protected properties, which could be turned into very-high-end housing with ground-floor retail. The port needs the money for historic preservation and is promising to build some waterfront parks, which is all well and good. But when it comes to building expensive housing along the waterfront, we’re dubious right off the bat — and even more dubious now that Port Director Monique Moyer is howling about the prospect of a 40-foot height limit.

Sen. Carole Migden has introduced legislation, Senate Bill 815, that would authorize the port to lease out for development lots that are now part of a state trust. But at the request of neighborhood groups, she wants height limits included in the deal as part of state law.

The port argues that 40 feet is too low for, say, three stories of housing above a storefront. Besides, port staffers say, zoning issues should be a local decision, and the state should hand over the lots and let the city decide on height, bulk, density, and appropriate use. In principle, we’d tend to agree with that — but the City Planning Department today is a disaster, with every key decision driven by developers, and the last thing this city needs is a string of high-rise condos on the waterfront.

If the port’s land is going to be developed, it has to be done with tremendous sensitivity, clear public benefits — and inflexible, mandated height limits. And if the money is going to go to parks, we’d like to see specifics, in advance: which projects will pay for which parks, and where — and what guarantees do we have that they’ll ever be completed?

This is the kind of decision that will affect the city for a century or more. Migden’s right: we should take it slowly and carefully. *

Yeah, man, I was there: I saw the Grateful Dead play "Dark Star" on New Year’s Eve. Heavy.

Only it wasn’t 1967. It was 1981, becoming ’82, and we were at the Oakland Coliseum, not the Panhandle. The Summer of Love was long gone; Haight Street was at war, not over drugs but over gentrification, and the cops were cruising up and down, looking not for hippies selling pot and acid but for the self-proclaimed Mindless Thugs, who were throwing bricks through the windows of upscale stores and fancy bars.

Everybody falls in love with San Francisco the way it was the day they arrived, and mine was a distinctly anarchopunk scene. The soundtrack wasn’t Scott McKenzie and flowers in your hair; it was Jello Biafra, "California über Alles," and the kids were getting all bloody and bruised from slam dancing in clubs with black walls instead of mellowing out and digging the colors of the trippy light show.

But the spirit of the 1960s was still very much alive. The Summer of Love gets a bit glorified in the retelling, but in the end the part that survived was a spirit of community and rebellion. We were here because we didn’t feel like we belonged anywhere else, and as quickly as we could set down roots, we decided it was our city and we wouldn’t let the greedheads take it away from us.

And it’s been an endless battle for the past quarter century, but the bad guys still haven’t won; though much is taken, much abides … and every year we celebrate the best of the world’s best city with the original, first-in-the-nation Best of the Bay.

This year’s issue is in part a tribute to that summer 40 years ago when a new kind of politics, music, and culture was emerging in a city where Bruce B. Brugmann and Jean Dibble were helping create a new kind of journalism. Our local heroes this year are all people who were part of the Summer of Love — and are still doing cool stuff today.

It’s also a tribute to everything sensational in San Francisco. And now and then and forever, there’s plenty. *

SONIC REDUCER "It was a period where you thought anything could happen," Thurston Moore once told me, talkin’ ’bout the early ’90s alternative rock scene spawned by Sonic Youth’s widely regarded masterpiece, Daydream Nation (DGC, 1988).

One might say the MTV-coined catchphrase "Alternative Nation" went as far as to take its cues from SY’s double disc, which was self-aware enough to dub a track "The Sprawl" and heady enough to venture into the big-statement two-LP turf also being hoed by once–SST kindred Minutemen and Hüsker Dü. Honestly, back in those hazy days, I recall giving it a handful of spins, sensing the distinct odor of a masterpiece, and immediately stopping playing it. Daydream was much too much, too rich for my blood, too jammed with the brainy, jokey pop culture ephemera that had riddled Sonic Youth’s LPs up to that point — positioned as the polar opposite of a hardcore punk 7-inch, which was short, sharp, and built for maximum speed. Yo, you’d never catch Minor Threat doing a double album. Instead Daydream thumbed its nose at the closeted cops in the mosh pit and unfurled like a dark banner announcing: We can’t be contained by your louder, faster, lamer rules. We’re gonna speak to a imaginary country — off Jorge Luis Borges’s and Italo Calvino’s grids — of naval-gazing, candle-clutching misfit visionaries looking for clues in trash cults, Madonna singles, and the burned-out butt end of the Raygun-era ’80s.

Now nearly 20 years old, Daydream — recently given the deluxe reissue treatment with an additional disc of live tracks — brings back memories of prophesy and triggers reminders of mortality. Around the time it first came out, I recall ranting to kindred record store clerks — and anyone who stumbled into my predated High Fidelity daydream — how everything will change when Sonic Youth meets Public Enemy. And it sort of did on Daydream, coproduced by Nicholas Sansano, who engineered PE’s ’88 masterwork It Takes a Nation of Millions to Hold Us Back (Def Jam).

Apparently we were also talkin’ ’bout nation building back then, finding a face and a place for a generation still living at home and struggling for an identity. Imagining a meeting of the most powerful forces in American rock and hip-hop seemed like the next best thing to moving out — and it foreshadowed Goo and touring collaborations to come. Little did I — or Moore — realize that a dozen years after Daydream Nation, the meeting of rock and rap would degrade into what Moore described as "negativecore" and rap-metal units like Limp Bizkit and debacles like Rapestock 2000. Daydream Nation offered a whole other, embracing view of a youth revolution with its opening track and college radio hit "Teen Age Riot." Sonic Youth had dared to write an anthem for a new age of kids, tagged with Kim Gordon’s "you’re it!" — and everyone was on the same page, stoned on Dinosaur Jr.–style Jurassic distortion and thinking-Neanderthal riffs and racing as fast as they could through dreamlike pop pastiche, as embodied by the accompanying video, a kind of decades-late Amerindie response to "White Riot" or "Anarchy in the UK."

On Daydream pop hooks emerged for the first time alongside the ever-coalescing SY aesthetic, with euphoric, charging chord progressions seemingly unrooted to the blues, and the way the group would open into intentionally pretty passages, flaunting the delicate uses of distortion and a feminized rock sensibility. We were all dreaming of Nirvana, a fringe seeping into the pop marketplace. Honestly though, listening to that Daydream again, I couldn’t help but be disappointed. Its brute approach has become a part of ’90s rock’s wallpaper — as Moore confesses in the reissue notes, black metallists have even owned up to copping licks from " ‘Cross the Breeze" — and therefore perhaps sounds more pedestrian. The triptych of "Hey Joni," "Providence," and "Candle" now sounds more charged than "Teen Age Riot" and "Silver Rocket," and I can’t help but think that Sister may be a stronger, more concise album. Perhaps we’re still too close to the stalled staling of the Alternative Nation, though maybe the faded nature of Daydream Nation is tagged to its very status as a classic — how does one pump life into, say, Sgt. Pepper’s Lonely Hearts Club Band?

It does help, however, to play it loud. *

HOT TO TROT: THE LOVEMAKERS

There was a time when the Bay’s Lovemakers looked like they were going to get all the love nationally — an Interscope deal tucked neatly into their back pocket and a heavy-breathing following around town. So what happened?

"Interscope asked us if we wanted to do another record," vocalist-guitarist Scott Blonde says from Oakland, "and we said no, because our A&R guy was obviously really into us and he and his assistant worked really hard for us, but it didn’t seem possible to get Brenda Romano, who runs the radio department, to get into it enough to put it ahead of 50 Cent and Gwen Stefani." He chuckles.

These days, the band members are focusing on making love on their own terms: their Misery Loves Company EP comes out July 24, the first release on San Francisco’s Fuzz label.

"Obviously we got more cash dollars’ support on Interscope," vocalist-bassist-violinist Lisa Light adds from the Mission District. "But the thing is the way it gets spent. Interscope would spend $5,000 doing stupid things — in bad taste a lot of times too. Not only were you embarrassed by the dumb posters they did, they weren’t in the right places. We’ve been able to hire a radio promoter and a cool PR company. It’s all about finding the people who actually care. You cannot pay for that at all."

"We’re looking at the future of music a lot, and selling CDs isn’t really part of the future seemingly," Blonde continues. "So it’s kinda about coming up with really innovative ways of getting our music out there in the biggest way possible." He says the Lovemakers have already gotten more radio ads on stations like Los Angeles’s KROQ for the first single off Misery than anything off their major label release: "We thought Interscope was going to be our ticket."

OPINION What would you think if somebody tried really hard to sell you an Edsel when you could clearly see a Lexus on the lot for the same price?

That’s what Mayor Gavin Newsom is doing with his "wi-fi everywhere" franchise deal.

The mayor put out a bid to get everyone in the city connected wirelessly at high speeds with a decent free service. What he has gotten instead is a deal that doesn’t guarantee anyone will be connected, with free service so slow even your dog wouldn’t use it.

Newsom wants reelection points for an approved deal now, knowing he won’t have to take reelection hits for the network when people see what they’re really getting:

If you want better than pedestrian speeds, you’ll pay fees comparable to those for DSL. But DSL is faster.

If you live above the second floor or away from the front of your building, or in various locations around the city, you won’t be able to get service at all. Too bad for you.

Service will drop out randomly without warning and may take days to fix.

Even only a few people at a time downloading things makes the service hideously slow for all of them.

The service uses the same frequencies as all the wireless gear people buy for common use. Use your wireless phone, ruin your Internet connection (and maybe your neighbor’s too).

Google and EarthLink get to snoop on you, your traffic, and your preferences. Good-bye, privacy.

The free service will operate at 300 kilobits per second — not even matching the 1,000 Kbps service that Google provides for free in Mountain View.

The underserved will remain underserved despite all claims to the contrary.

While Newsom has been pushing wi-fi, optical fiber has become really cheap. But Newsom is ignoring fiber in favor of his pet wi-fi project. Newsom’s friends have been attacking various supervisors for failing to pursue the wi-fi deal, but the supes are looking at fiber as an excellent reason to drop wi-fi entirely. Why? Here’s what you get with community optical fiber:

A connection of 1,000 megabits per second. Not 300 kilobits, not six megabits, but one gigabit.

Potential savings of $1,000 per year per consumer.

Near-absolute reliability.

No slowdowns due to congestion.

No snooping.

Anyone on the network can become a video producer for the entire world.

The elimination of monopoly control over our communication networks and a permanent commitment to network neutrality that can’t be overcome.

People have asked Newsom why he won’t offer free fiber connections to underserved community centers if he cares about them as much as he claims. He gives no answer: "Let them eat 300 kilobits."

It is the height of folly for a politician to pursue a bad promise to deliver poor services when the same politician could claim to be keeping up with the times and has something much, much better to offer. But that appears to be Newsom’s reelection strategy. He wants to give us an Edsel while pretending it really is better than the Lexus we can clearly see despite his best efforts to hide it. I’ll vote for the person who wants to sell me the Lexus. *

Gutting campaign reform

EDITORIAL A bill that could gut many local campaign finance laws is zipping through the legislature with the support of both the Republican and Democratic parties — and only a few activists seem to be paying attention. We’ve written about the bill, AB 1430 by Assemblymember Martin Garrick (R–San Diego), on the politics blog at www.sfbg.com. It has already cleared the State Assembly, 77–0, and is headed to the State Senate floor, where only one member — Carole Migden of San Francisco — has come out in opposition.

The Republicans and the Democrats love this bill because it would allow their parties to use unlimited amounts of money to support local candidates. That’s become increasingly common in this state; when cities set strict limits on contributions to political candidates, the candidates simply ask their big-money backers to give the money to the state Republican or Democratic Party — which then funnels the laundered, uncontrolled, and often unreported cash into local campaigns.

In fact, the bill comes from the San Diego GOP, which is angry that the San Diego Ethics Commission tried to crack down on nearly a million dollars in unregulated money that went to local races last year.

The bill talks about "membership communications" — as if the parties were simple nonprofits that wanted to send newsletters to their members. That’s not what’s going on at all, and everyone with any sense knows it. Here’s the real story: while the federal and state governments have refused to do any real campaign finance reform, cities and counties all over California have tried to fill the gap. The San Francisco Ethics Commission — for all of its obviously failings (see "Whose Ethics?," 7/11/07) — has the authority and the mandate to regulate local campaigns far more tightly than the state’s Fair Political Practices Commission. So the big donors, working through the state parties, are trying to figure out ways to circumvent local rules.

The conservatives in the State Legislature love to talk about local control when it comes to workplace regulations, environmental protection, and schools — but when a bill like this comes along and threatens to eviscerate local control, they utter not a peep. Nor, for the most part, do the liberals, who are aligned with the Democratic Party and don’t want to defy its mandates.

The San Francisco Ethics Commission has asked Mayor Gavin Newsom and the supervisors to oppose this bill, but the board has taken no action, and the mayor says he actually supports the bill. That’s a disgrace: at the very least, the supervisors should pass a resolution opposing AB 1430 and force the mayor to veto it.

Migden, after talking to the folks at California Common Cause, the public interest campaign organization, took a bold stand against the measure, and she deserves tremendous credit for that. Now the rest of the senate — starting with Leland Yee of San Francisco and President Pro Tem Don Perata of Oakland — needs to go along and kill this monster. *

Importing injustice

More than 100 tractor trailers were lined up at 6:30 a.m., inching toward the Port of Oakland’s Terminal 7, waiting for their next load. Against the backdrop of the San Francisco skyline, a mammoth freight ship emblazoned with the name Hyundai glided toward the port, pregnant with multicolor shipping containers.

A driver told the Guardian that he expected to be in line for at least two hours waiting to drop off the empty container attached to his big rig. His 1989 truck lacks air-conditioning, so the windows were rolled down, allowing diesel exhaust to pollute the air he was breathing.

It’s the same scene at many of the port’s other terminals: long lines of ancient trucks slowly snaking toward their destinations, their primarily immigrant drivers performing the essential and thankless task of transporting cheap clothes from Asia to the nation’s big-box retailers or helping to export California’s agricultural goods to Hawaii.

The fourth-busiest container port in the nation, the Port of Oakland is the economic engine of the region, providing thousands of jobs and more than $1 billion in revenue. But activists say that the port system has also led to sweatshoplike conditions for truckers and created a health crisis for the surrounding community.

On their poverty-level wages, truckers are usually able to buy only the oldest, most polluting trucks. Their diesel pollution is a major factor driving asthma rates through the roof in the neighboring, primarily African American neighborhood of West Oakland, where, the American Lung Association says, one in every five kids has asthma.

A new national coalition of labor, environmental, and community activists has advanced a proposal that would make all drivers employees with benefits, radically changing the way work is done on the waterfront and possibly heralding the return of the Teamsters to the ports for the first time in more than 20 years. In the process, the proposal would make the port’s biggest customers responsible for its environmental problems.

The coalition places the blame for the current situation squarely on giant retail shippers such as Wal-Mart and Target and is calling for them to be held accountable for the full environmental and labor costs of the cheap goods they sell — a call the corporations are strenuously resisting. The American Trucking Association, whose members contract directly with the corporation, has threatened a lawsuit if the change is adopted. But port officials have voiced a willingness to seriously consider implementing the proposal.

Having long claimed that the trucking industry is outside its control, the Port of Oakland could embrace the proposal as a means of satisfying community, environmental, political, and business concerns. With impending directives to clean the air coming from Sacramento, trade planned to almost double by 2020, two new Port Commission appointees representing labor and environmental concerns, and a federal antiterrorism tracking plan slated for this fall, the port is poised to play a leadership role that could reverberate up and down the West Coast and across the country.

THE TRUCKER’S LIFE


The Port of Oakland’s estimated 1,500 to 2,500 drivers are a far cry from the middle-class, long-haul Teamsters and the Smokey and the Bandit–<\d>style freewheeling rebels who have long been engrained in the American imagination. Instead, they are at the bottom of the port’s food chain and are the most exploited trucking sector in the country, consisting primarily of recent immigrants struggling to make ends meet.

Dawit Fre, 39, immigrated to Oakland from the small nation of Eritrea two years ago. "I wanted to see a better life," he told us. Fre was a driver in Africa and went to work for the Port of Oakland after his cousin told him people start their trucking careers there. He said he works up to 60 hours a week for one company, making the equivalent of about $8 an hour after expenses.

Fre arrives at work every day no later than 6:30 a.m., waits for dispatches from his company, and spends a minimum of two hours in line for each container he picks up or drops off. He is paid $42 for each load by the company. He doesn’t know how much the trucking companies make but has heard that some get $200 per load. He returns home around 6:30 at night.

"The whole time I’m at the port, I’m thinking about my family," he said. "I got children. The only thing I’m thinking inside the terminal is, how many moves am I going to do? Am I going to do four or five or three or two?"

On a good day he can get four, on a bad day as few as one, depending on the length of the lines and the generosity of the dispatcher. Then there are his expenses. As an independent operator, Fre is solely responsible for a tankful of diesel that costs him up to $250 a pop. DMV registration is $178 a month, and 12 percent of his weekly earnings goes to his boss for insurance on his truck, not to mention annual federal income tax.

He receives no benefits, no overtime pay, and no health care coverage at a time when his wife, a diabetic, is suffering from severe stomach complications. "I’m taking her to Highland Hospital," he told us. "If it’s easy for them to fix, they can do it. But if she has a big problem, they can’t do it."

Fre has his own health problems. "Most of the drivers, we have old trucks," he said. "You don’t have AC, your windows are down, and you get sick in the truck" from the diesel. Fre’s remedy for his persistent coughing and the burning in his throat is several glasses of milk after each day of work.

A 1998 study published in the Journal of Independent Medicine found that truck drivers face a risk of cancer 10 times greater than Occupational Safety and Health Administration–acceptable levels, and a 1990 study published in the American Journal of Public Health showed that truckers face nearly double the average lifetime lung cancer risk.

Fre has little money to invest in his truck, a ragged 1987 model that he said needs $5,000 in repairs. He doesn’t trust it on the freeway, so he’s asked his dispatcher to send him only from pier to pier, not outside the port, further dipping into his earnings. "I came here to see a better life," he said. "When I got here, I found it is different. Here we don’t get paid for the overtime. We don’t get benefits. When I get into the terminal, there is no respect."

His experience is typical of those of port truckers across the country. A study by the East Bay Alliance for a Sustainable Economy, a labor-affiliated think tank, found that the average Port of Oakland trucker makes as little as $8 an hour after expenses, works 11 hours a day, and spends two and a half hours in line per load. Almost none of the truckers reported receiving benefits on the job, and 66 percent don’t have health insurance.

This is consistent with data from a 2004 survey of port truckers in Los Angeles and Long Beach, conducted by a professor of economics at California State University Long Beach. That report found they had a median income of $25,000 a year after expenses and an average workday of 11.2 hours, with up to 33 percent of their time spent waiting in line.

Port truckers generally drive only the oldest, most polluting trucks because that’s all they can afford. An industry adage is that ports are "the place trucks go to die," a reality that has dire impacts on the surrounding communities.

POLLUTING THE COMMUNITY


West Oakland has long been a dumping ground for the Bay Area’s toxic waste. The community has one of the five highest asthma hospitalization rates in California, with an estimated 20 percent of its K–<\d>12 students suffering from the disorder, according to the ALA. Researchers at the University of Southern California have found that children living within a few hundred meters of freeways leading out of ports not only are more likely to suffer from asthma but also actually develop smaller lungs.

Margaret Gordon, a 60-year-old community health activist who has lived just blocks from the Port of Oakland for 15 years, told us that she and four of her grandchildren living with her all suffer from asthma. When one grandchild was born with severe asthma and her own asthma worsened after she moved to West Oakland, Gordon, then a housekeeper, started reading about the causes of asthma and made the connection to the port. Like many in the low-income neighborhood, she cannot afford to move elsewhere in the Bay Area.

Gordon has been fighting for clean air for more than a decade, and in April she was inducted into the Alameda County Women’s Hall of Fame for her work. In 2001, Gordon formed the West Oakland Environmental Indicators Project, which she now cochairs. The project has released more than half a dozen studies related to air quality. A 2003 report showed that trucks traveling through West Oakland in one day produce the same amount of toxic soot as 127,677 cars, leading to indoor air in some neighborhood homes that is five times more toxic than that in other parts of the city.

Still, Gordon told us that port officials are "only starting paying attention." Last year the California Air Resources Board passed a resolution related to air quality at ports and announced that it was developing a regulatory mechanism. A 2006 CARB report found that truck diesel exhaust accounts for the majority of the estimated 2,400 deaths related to freight transport each year and 70 percent of the state’s air pollution–<\d>related cancer risk. Freight transport will cost California residents $200 billion in health costs over the next 15 years. Most of this is borne by low-income communities of color near freight transport hubs.

The combination of state mandates and local community concerns is starting to spark a change. "They would sit down and talk with us before that, but there was not anything concrete done," Gordon told us. The port is now in the early planning stages of an air-quality-improvement program, working with Gordon and other activists.

That movement is getting vigorous new support from the Coalition for Clean and Safe Ports, a national partnership of labor, environmental, and community activists organizing at the country’s major container ports: Los Angeles, Long Beach, Miami, Oakland, New York–New Jersey, and Seattle.

"Every one of those ports has the same environmental and labor problems we have in Oakland," Doug Bloch, the coordinator for the coalition in Oakland, told us during a tour of the port’s heavy industrial landscape. Virtually all of its 900 maritime acres are covered by concrete and asphalt, monster cranes that inspired Star Wars‘ Imperial Walkers, and 20-foot steel containers stacked up like Legos behind chain-link fences.

The Port of Oakland has no direct relationship with its truckers at the present. Shippers take price bids from among roughly 100 trucking companies at the port, then contract the work to the independent-contractor truckers. The CCSP says bidding wars lead to poverty wages for truckers, older trucks and more pollution, and a chaotic port full of inefficiencies like long pickup waits.

Under the proposed system, ports would call on their ability as landlords to set standards for the trucking and shipping companies. They would require trucking companies to hire drivers as employees, shifting maintenance costs from the drivers to the companies, which would retrofit or replace all port trucks with more environmentally friendly rigs. The ports would allow only new, cleaner trucks to enter. The companies could then, in theory, pass the costs on to shippers and end users.

If drivers were paid as employees by the hour instead of by the trip, the coalition expects the market would reduce inefficient truck wait times and air pollution.

"When you rent an apartment you sign a lease," Bloch told us. "If you trash the place, you get evicted. Corporations are trashing this community, but they’re not being evicted."

A test case could soon be under way at the ports of Los Angeles and Long Beach, the two largest in the United States, and the situation is being closely watched by ports and industries across the country. Port commissioners there had hoped by the end of this month to approve the coalition’s program, which they expect to reduce diesel truck emissions by as much as 80 percent over the next five years. But growing opposition and the threat of lawsuits by groups like the California Trucking Association, which represents the owners of truck companies, and the Waterfront Coalition, a consortium of major retailers, led the ports to delay their decision. The commissioners now expect to vote in September after completing an economic impact survey.

At the center of the storm is the fact that as employees, truckers would be able to organize and form a union. As independent contractors, they are barred from doing so because of antitrust laws originally created to oppose vast enterprises that dominated industries. (A further irony is that giant retail steamship companies have experienced incredible consolidation and enjoy a limited antitrust immunity.)

If passed by LA port officials, the plan would be implemented there starting Jan. 1, 2008, and could result in a domino effect at the other, smaller ports across the country. "The industry is fighting like hell in LA," Bloch told us. "They know that if they’re going to have to pay, the party’s over."

Meanwhile, Bloch told us that more than 1,000 truckers have signed a petition asking the Port of Oakland to pass a version of the coalition’s proposal, and it will be presented to the Port Commission, the seven-member body that would eventually vote on the proposal. Spokesperson Libby Schaff told us that the port "agrees with the coalition that the port can and should have a more direct relationship with its truckers" and is "very seriously considering the coalition’s proposal."

Because the proposal "constitutes a major overhaul of the way trucking is done today," Schaff said the port is currently holding stakeholder meetings with residents, truckers, terminal operators, elected officials, the business community, and labor to consider it in the context of a more comprehensive port plan. Schaff said a comprehensive plan could be crafted in less than a year.

The port has not taken a position on granting truckers employee status. It is also looking into other funding mechanisms for a clean-truck program, including money from a pending state bill that would impose a $30 fee on every 20-foot-equivalent unit passing through the Los Angeles, Long Beach, and Oakland port complexes, to be used for improvements in road and rail infrastructure and for clean-air programs.

The legislation, Senate Bill 974, by Alan Lowenthal (D–Long Beach), would generate more than $525 million annually. But it faces tough opposition from some very powerful interests.

RESISTING CHANGE


Bill Aboudi, president of Oakland’s AB Trucking and a member of the CTA, told us truckers are "treated like second-class citizens," and he believes long lines and trucker asthma are serious problems. But he strongly opposes the coalition’s proposal. Instead, he told us, state regulations like those forthcoming from CARB and other piecemeal reforms are the answer.

"The coalition’s main goal is to unionize the drivers," Aboudi said. He was wearing a baseball cap emblazoned with two American flags and the words "Oakland Trucker." An immigrant from Israel, he has been at the Port of Oakland since 1992. "If these guys choose to be owner-operators, why are you rocking the boat? You can’t be playing with my livelihood just because you want to get union dues," Aboudi said. "Truckers want to own a piece of the American dream. They want to own their own truck."

It’s an appealing image to many. Kevin Leonard, an owner-operator trucker who contracts with Aboudi and others, told us he doesn’t want to give up his independent status. "I have the freedom to work when I want," he said. "I don’t see how the Teamsters can represent me better than I can."

The trucking industry as a whole says the coalition plan will force away trade and drive out small trucking companies, which will have to maintain the trucks and start paying benefits such as health insurance and workers’ compensation.

Yet Assemblymember Sandré Swanson (D–Oakland) brushed aside those arguments. "I’ve been involved in Bay Area politics for more than 30 years," he told us. "I’ve seen these same claims made against farmworkers as they were organizing for better conditions. I’ve seen these arguments made when we were raising the minimum wage. I think the opposite is true. If you have a workforce with a livable wage, it’s a more productive workforce, and I think everyone benefits. Truckers deserve more, and we’re going to do what we can to help them."

Oakland City Council president Ignacio de la Fuente, who drafted and helped pass a minimum-wage law for port employees, told us he supports the right of truckers to unionize but labor and environmental concerns must be balanced with economic growth. "You can’t ignore the fact that you have the port of Oakland competing with other ports," he said. "I support the fact that the Teamsters are going to bargain collectively on a national level. This port competes with other ports, and you cannot be put at a disadvantage."

Bloch says the coalition’s target is the shipping companies, not the trucking companies. "The shippers are hiding behind the trucking companies," he told us. "On the one side there are the giant shipping companies, like Wal-Mart and Target, huge global companies that demand low prices from trucking companies. On the other side are tiny trucking companies, immigrant truckers, and communities of color. Wal-Mart’s slogan is ‘always low prices,’ but ‘always low prices’ means one out of five children in West Oakland with asthma and drivers making $8 an hour who can’t support their families."

Oakland mayor Ron Dellums may be signaling his support for reform with two new appointees to the Port Commission. Even before he took office, Dellums was working to influence the Port Commission; as mayor-elect, he requested that outgoing mayor Jerry Brown hold off on appointing a new nominee so Dellums could appoint someone working on environmental and community impacts. He lost this battle when a majority of the city council voted to appoint Mark McClure, the director of marketing at a business technology company focused on security.

Dellums’s latest appointees, announced earlier this month, are a marked contrast to the business-oriented appointees of the Brown era: Victor Uno, a financial secretary with the International Brotherhood of Electrical Workers, and Gordon, the longtime resident and environmental activist in West Oakland.

"The port’s policy has been all about business and not about the people," Gordon told us. "The mayor really wants someone there to talk about health issues. I have never known a mayor to put someone on the commission and one of their engagements is to talk about health." She would also like to see a public participatory-process policy built into the port. "This is about sharing the power," Gordon said. "I don’t think West Oakland residents know they have power." She has "no problem" with truckers unionizing but also wants to find a way for drivers to remain independent contractors if they prefer.

Uno told the Guardian that he is highly supportive of the proposal. "I think that if the whole commission takes the lead of Mayor Dellums that this proposal will be very seriously considered," he said. "I’m very optimistic." Asked if he thought a proposal could succeed without requiring trucking companies to hire truckers as employees, he said, "I do not see how that is possible, given the lack of regulations in the trucking industry. It’s a dog-eat-dog world among independent truckers."

DEREGULATION HISTORY


The ports were not always structured as they are now. Before the 1980s the Interstate Commerce Commission regulated trucking, and most truckers at California ports were members of the Teamsters. They had health care, pensions, and workers’ compensation insurance and were paid a middle-class wage.

As part of a national push toward deregulation in the late 1970s, Congress, spurred by President Jimmy Carter, deregulated the trucking industry in 1980. In the following few years, a flood of new trucking companies entered the ports, with shippers choosing between a growing number of companies for each job. As small trucking companies undercut one another in bidding wars, the falling rates translated into declining driver pay, the bankruptcy of Teamster-organized companies, and increasing reliance on independent contractors whom companies could hire without spending money on payroll taxes, health care costs, or other benefits that unions might try to extract.

Trucking expert Michael Belzer, an economics professor at Wayne State University, has shown that long-haul truckers now earn less than half of prederegulation wages and work an average of more than 60 hours a week, while retailers like Wal-Mart have thrived. "The low rates paid to truckers in this global-trade game acts as a subsidy for increasing the amount of trade," Belzer told us. "Pollution and safety hazards are the negative externalities." If all ports on the West Coast required employee drivers, he said, "the market result would be that cost and safety would go up, and pollution would go down."

There have been a handful of Teamsters-related or trucker-led rallies and work stoppages at the Port of Oakland since deregulation, including a technically illegal strike in 2004 protesting the soaring price of diesel fuel, which virtually shut down the port for eight days. Many of the same complaints of today’s port truckers were aired at that time — long waits in lines, poor pay, long hours, and no benefits.

"This business is like the Mafia," Lorenzo Fernandez, 36, said, standing in front of two metal taco trucks glinting in the noon sun, along with about a half dozen other truckers on their lunch break. "They’re doing whatever they want with us, between the [truck companies] and the shippers. There is so much competition between the companies, and they know that we need the job. They know that our kids will go hungry."

Muhammad Khan, 33, said he’s sometimes forced to make up for long wait times by driving dangerously fast on the freeways. "We have our families. We have to take care of them. We all risk our lives because we have to. We don’t make enough money if we don’t make a load," Khan told us.

"We’re all immigrants here," Fernandez said. "We make it possible for the economy to grow up, but they’re stepping on our faces…. We have to work together. Otherwise we are going to be slaves for life."

A sign on a chain-link fence near the taco trucks reads, "Got an old truck? The Port of Oakland can help! Replace your old truck today!" Call the number at the bottom of the sign, and a recorded message issues an invitation to an informational barbecue that took place four months ago. The message explains that the port will provide qualifying owners with up to $40,000 to replace trucks dating from 1993 or before with a 1999-model truck. But Schaff told us, "Due to overwhelming demand, new applicants are currently not being accepted."

Money for the program came from a $9 million settlement of a lawsuit West Oakland residents filed against the Port of Oakland in 1998, alleging that their health was being harmed by port operations. The port says it will replace a total of 80 of the estimated 2,500 port trucks with those funds. When asked if the port had a responsibility to truckers, Schaff said it was "consistent with the port’s commitment to social responsibility…. We’ve done a lot, and we’re going to do more."

But the only specific programs the port could point to were the truck replacement program, a trucker access committee and working group started after the 2004 strike, and new GPS cell phone technology that is being touted as a solution for bottlenecks. Chuck Mack, the Teamsters’ Western Region vice president, isn’t impressed. "They’re a joke," he said of the programs. "Very few independent contractors have utilized them."

The recent purchase of the GPS system particularly irritates Mack. "Here is a quasi-governmental agency supplying services to the trucking companies," he told us. "It’s bizarre that we’re using taxpayer money for this. Any other industry would buy the devices themselves."

"We don’t disagree with using this money" for truck replacement, Mack said, "but what you’re doing is blowing $2 million in taxpayer money. Years down the road they’re going to need a new truck and another million in taxpayer money. For Wal-Mart and Target it’s great because they can have the taxpayer pick up the bill. Without changing the model, it’s just a short-term fix at the expense of the taxpayer."

EMPLOYEE BENEFITS


Beyond the environmental and economic benefits of making truckers employees of the companies, the change also might improve port security. The federal Transportation Worker Identification Credential program, expected to be implemented in the fall, will check the identities of the nation’s 750,000 port employees, 110,000 of whom work as truckers. Under the present system, there is no way to track the independent port truckers.

Employees are easier to track, and they are also better for port security in other ways. Among low-paid port truckers, turnover rate is extremely high, according to the ATA. "We all know that having a stable, well-trained, reliable workforce only leads to more security," Bloch said. "If they’re trained, they can be the eyes and ears of the port."

Well-paid truckers also would lead to safer ports. In a 2005 report, Belzer showed that "a substantial fraction" of independent operators actually loses money each year, resulting in "a high risk of unsafe operations among those earning the least money." The low compensation also "presents a national security risk," his report read, "since those who desperately work to break even might be at risk to engage in activities that put the nation at risk, whether intentionally or unintentionally, just trying to find a way from not going under."

Driving past another long line of trucks idling outside a gate after lunch break, Bloch pointed out one truck. A placard on the back of the rig read, "End sweatshops on wheels."

The current port system "just heaps abuse and abuse on these truck drivers and this community," Bloch told us. "The big businesses like Wal-Mart don’t pay the cost of polluting Oakland. It’s the truck drivers and the community that pay the cost. People pay with their lives."

"You can’t fix the environmental problems without fixing the problems of the driver," he said. "And now you have labor and the community coming together, and that’s powerful."*

Hyphy and its discontents

Send a 911 to the 415 and 510: does hyphy have a pulse? Several articles in recent months have suggested the answer is no. A May 13 San Jose Mercury News article, "What Happened to Hyphy?" by Marian Liu, for example, insists that a year ago, "the Bay Area seemed poised to become the center of the hip-hop universe," when, we are told, the genre "was ubiquitous at clubs, on the streets and on local radio stations." Now hyphy is "listless, with even local popularity beginning to dissipate."

This account of the rise and fall of hyphy is exaggerated to the point of fiction. Bay Area hip-hop has, of course, been cracking for at least two and a half years, following a long post-Tupac period of commercial decline now referred to as "the drought." But while the amount of local spins Bay Area music received increased, hyphy was never anything like ubiquitous on the radio. The small number of major-label signings never threatened to displace any presumed center of hip-hop’s stubbornly regional universe nor does such an image convey what’s been at stake in the Bay’s struggle for recognition.

According to the Arbitron radio ratings system, San Francisco is the fourth-largest market in the country, after New York City, Los Angeles, and Chicago. This figure includes Oakland but not Sacramento or San Jose, which are classed as separate markets but are considered by everyone from the rappers to the media and the listeners as part of the Bay Area in terms of hip-hop regions. All Bay Area artists want is to be treated like other rappers in similar areas of the country. Rappers from smaller markets like Houston (number six), Atlanta (number nine), Miami (number 12), and even St. Louis (number 20) routinely receive local airplay, major-label deals, and national exposure.

Only the Bay is denied such opportunities. While the publicity of E-40’s 2005 signing with BME/Warner Bros. scored hyphy coverage in national media like USA Today and secured the Bay its own episode of MTV’s region-oriented rap show, My Block, the music hasn’t had a chance to blow up. With the exception of E-40 — whose gold-selling 2006 album My Ghetto Report Card (BME/Warner Bros.) ensured a Warner Bros. release of his upcoming The Ball Street Journal — no Bay Area hip-hop artist has been permitted to drop a big-label full-length in the past two years. Albums by the Pack on Jive, Mistah FAB on Atlantic, Clyde Carson on Capitol, and the Federation on Warner Bros./Reprise have all experienced frustrating delays, fostering the notion that hyphy is foundering. But not everyone agrees with this impression.

DEAD OR ALIVE?


"How can hyphy be dead when the key players are still there?" 19-year-old producer extraordinaire and Sick Wid It Records president Droop-E asks. It’s a good question, for if the short history of the hyphy movement has proved anything, it’s that there’s no lack of hot Bay Area acts, from vets like Keak Da Sneak to new artists such as FAB to rappers who came up during the drought and didn’t get to shine, like Eddi Projex (formerly of Hittaz on Tha Payroll) and Big Rich (once of Fully Loaded). Carson, the Jacka, Beeda Weeda, J-Stalin, the Federation, Turf Talk, Kaz Kyzah, San Quinn, Messy Marv: the list of major-label-level talent only begins here, and the extent to which any of the above identify as hyphy hardly matters, inasmuch as for the rest of the country, hyphy stands for Bay Area hip-hop.

Many of these rappers predate hyphy, and while the word definitely has musical signification — it’s a fast, club-oriented sound inspired by crunk but transformed by electronica and techno flourishes — its most important function has been as a marketing tool to direct national attention back to the Bay. To write off hyphy as a passé trend is, in this sense, to write off the region, leaving the Bay back where it started.

Further complicating any so-called postmortem analysis of hyphy is the fact that the term also refers to the Bay Area culture of disaffected hood youths known for white Ts, dreadlocks, and ghost riding. "Hyphy is part of the street," Droop-E affirms, noting that the culture emerged before the name was attached or the music drew attention to it. The merging of this culture and a particular hip-hop sound in a single term is what makes hyphy so potent a concept, functioning in a manner akin to the word psychedelic in the late ’60s. This union between a lifestyle and an aesthetic is the chief justification for considering hyphy a movement, however vaguely articulated.

"The hyphy movement reflects what’s going on in the streets," Federation producer and national hitmaker Rick Rock says. "That will never die, as far as that goes. The kids are going to be hyphy. But the music — you don’t have to say ‘hyphy’ to do a hyphy song. If people are saying ‘go dumb’ on 10 different songs on the radio, then you’re shooting yourself in the foot."

Traxamillion — another architect of the hyphy sound and producer of Keak’s local number one hit "Super Hyphy" — agrees the music could be "losing its edge due to oversaturation of the same topics: scrapers, purp, pillz, shake ya dreads, and stunna shades," underscoring the tension between hyphy and a region whose rappers pride themselves on originality. Yet if hyphy’s lyrics often suffer from an overreliance on now-established slang, the limitations of its subject matter hardly seem greater than that of mainstream rap; the high-fashion emphasis of East Coast rap is infinitely more tedious.

In any case, Rock’s response has been to reinvigorate hyphy through the innovative impulse that led to its current form. "That hyphy sound I blueprinted, I don’t have to stay with it," Rock says. "Hopefully people will gravitate toward the new music, and that’ll be the new hyphy."

NEW SICK SOUNDS


Rock is leading the way with the Federation’s thrice-delayed It’s Whateva — finally to be released by Warner Bros. on Aug. 14 (see sidebar) — and his production on "I Got Chips," the guitar-driven first single off Turf Talk’s West Coast Vaccine (Sick Wid It), released in June. One of the year’s most anticipated Bay full-lengths, Vaccine more than fulfills its buzz. Besides the excellence of its composition as an album, it displays Turf Talk’s tremendous artistic growth in the number of flows he adds to his characteristic bark, from a whisper to a lazy drawl to a hyperactive bellow.

While Droop-E confirms that several major labels expressed interest in Vaccine, ultimately none pulled the trigger. Yet deals of various sorts keep trickling in, most recently for Keak, whose camp confirms his recent signing to national independent Koch. Tha Mekanix production squad is negotiating a rerelease of J-Stalin’s On Behalf of the Streets (Zoo Ent., 2006) through one of the biggest independent distributors in the States, Select-O-Hits. And more major-label ice has begun to thaw, as the Team member Carson reports that Capitol is leaning toward a mid-October release of his solo debut, Theatre Music.

"It’s going to be real good for the Bay," Carson says of his ambitious project, originally conceived as one continuous track, à la Prince’s Lovesexy (Warner Bros., 1988), though Capitol has nixed this risky idea. Yet Carson insists the album "will still be one body of music." Cobranded by the Game’s Black Wall Street Records and boasting appearances by the multiputf8um rapper, Theatre Music finds Carson busting over big-time beatmakers like Scott Storch and Wyclef Jean, and it’s hard to imagine Capitol squandering such resources.

SO HARD ON THE FUNKY RADIO


Another symptom of hyphy’s alleged demise, offered in the Merc and elsewhere, is its lack of current radio play. Yet if there’s been no recent hit on the level of Keak’s "Super Hyphy," it’s because KMEL and other hip-hop stations have withdrawn support for local music.

"The radio play on the hyphy movement has definitely slowed down," Traxamillion says. "They play a few Bay joints here and there, but overall I feel a lot of the radio play is coming to a halt."

Mistah FAB, for example, has a pair of new singles, "Goin’ Crazy," highlighting Too $hort and D4L of "Laffy Taffy" fame, and "Race 4 Ya Pink Slips," with Keak and Spice 1. But you’ll never hear these on KMEL, as the station has stopped playing FAB.

"It’s the politics of radio," says FAB, who claims that since he accepted his Friday-night radio gig at KYLD, he’s been subject to an unofficial ban at KMEL, courtesy of musical director Big Von Johnson — though both stations belong to Clear Channel. "As an artist, I find this hard to accept," FAB confesses. "As a businessman, I realize why." Nonetheless, FAB was surprised that ending his radio show had no effect on the ban.

"It hurts the movement," he says, and he’s right. His 2005 radio hit "Super Sic Wit It" was one of the catalysts of hyphy, bringing other local music in its wake. "If we can’t get the support here at home, how can we expect to break nationwide?"

FAB has a point: local rap needs radio to generate sales, which in turn generate label deals. At press time, Johnson hadn’t respond to several requests seeking his side of the story, yet the Arbitron ratings speak for themselves.

In summer 2006, when it was playing hyphy, KMEL was the number two station in the market, after KGO-AM talk radio. That winter, when it began slacking off, KMEL finished at number seven, tied with KYLD. (Spring ratings aren’t yet posted.) This is difficult to reconcile with the claim that hyphy’s popularity has dissipated. Yet while hyphy — and by extension, Bay Area rap — may never break nationally if KMEL doesn’t support it, even fewer people will tune in to KMEL if the station doesn’t play it.

Nearly every Bay Area rapper I’ve met seeks what Messy Marv once called "that major label shine." Yet the lack of hyphy-era major-label-deal flash — or rather follow-through — thus far may stem more from the general decline of the corporate music system than from the strength or weakness of local hip-hop. Fewer major-label albums are being released now compared with earlier periods of pop, and those imprints are generally taking fewer chances and are often unable to move fast enough for rap. Radio, moreover, has lost at least a portion of its audience to Internet alternatives like MySpace and YouTube, both of which FAB credits with mitigating the impact of absent radio play. Given the fact that a popular independent artist can potentially make more money — at the price of much glory, perhaps — than many bigger names, it’s hard not to wonder if the major labels do hip-hop more harm than good. It’s something to consider as we wait to see if the Federation’s new album, whateva its final form, keeps hyphy’s momentum alive.*

The new midnight

"Nine p.m. is the new midnight," declares Will "the Thrill" Viharo, programmer and host of Thrillville, the East Bay’s giant cocktail shaker of B-movie bliss. Turns out Thrillville’s earliest incarnation was as the Midnight Lounge, which Viharo first oversaw in April 1997, just a few months after Oakland’s Parkway Speakeasy Theater opened. After a particularly scorching Elvis tribute event, Viharo decided his gig, eventually dubbed Thrillville, was ready for prime time. Viharo’s delightfully sleazy tastes ("A lot of old AIP stuff — Amazing Colossal Man, I Was a Teenage Frankenstein [both 1957] — mixed in with ’60s drug movies like The Trip [1967] and blaxploitation like Shaft [1971]. I really stuck to stuff that I loved") earned him a loyal following. He’s now the programmer and publicist for Speakeasy Theaters and hosts monthly Thrillvilles at the Parkway and the Cerrito Speakeasy Theater — both of which offer menus of beer and pizza — as well as the occasional road show.

Though he’s a devoted film fan ("My life’s a B movie. People like what they can relate to"), Viharo, whose events feature his wife, Monica Tiki Goddess, and any number of special guests, sees Thrillville as much more than just a screening. "I realized I needed to turn it into a showcase. That’s why I call it a cult-movie cabaret. I’m incorporating elements of the TV horror hosts of the ’70s but also the old midnight ghost shows from the ’40s, ’50s, and ’60s. And also burlesque. The irony there is that burlesque houses back in the ’30s and ’40s actually gave way to grindhouses. And Thrillville is a combination of both — we’re basically bringing them back together."

Coming up at Thrillville: ever-popular tributes to the King (Viva Las Vegas, 1964) and William Shatner (Incubus, 1965), a spooky "Zombie-Rama" double bill, and, hopefully, the ultrarare Bare Knuckles (1977), which stars the fez-topped MC’s father, Robert Viharo. If all goes well, Quentin Tarantino will loan his print of what the Thrill proudly calls "the ultimate sleazy ’70s grindhouse flick." (Cheryl Eddy)

What is Water?

The best reissue independent in the country? A label fueled by Cat Power and other wistful girls strumming plaintive guitars? Perhaps the ’60s and ’70s reissue imprint — along with Runt, its Oakland distribution parent company, and its associated sister labels — got to where it is because owner Filippo Salvadori had the foresight to put out the first LP, 1995’s Dear Sir, by the ageless, Karl Lagerfeld–anointed troubadour Cat Power, née Chan Marshall, foreshadowing Water’s releases by femme folkies such as Judee Sill and "Windy" songwriter Ruthann Friedman, once lost but now passionately hailed by fans like Joanna Newsom and Devendra Banhart, respectively.

Or maybe the Runt-Water phenomenon all started with a simple scenario familiar to music fans of a certain age when, back in the plastic age before cable, the Web, IM, MySpace, text messages, and the lot, as Pat Thomas — longtime Runt staffer and Mushroom drummer and onetime respected San Francisco folk label Heyday owner, a "detective and general errand boy" who’d track down artwork, master tapes, and families that own publishing rights — puts it, "The only thing to do was smoke a joint and listen to an album. So you really got into your albums. That was your entertainment."

And that was the reason why Thomas and the rest of Salvadori’s small staff would later lovingly dust off and rerelease those precious artifacts from the lazy days of endless summer, multiuse gym socks, wood-grain stereo consoles, and just three channels on the boob tube, unearthing and restoring previously unheard gems along the way. As monolithic major labels tighten their catalogs and slap together cookie-cutter reissues with cut-rate art, it’s come down to indies like Seattle’s Light in the Attic and Coxsackie, New York’s Sundazed, and Runt (named after Salvadori’s favorite Todd Rundgren LP) and its imprints Water, 4 Men with Beards, Plain, and DBK Works to dig into swelling back catalogs and curate with the care that makes true music geeks and retro hipsters want to snag everything they issue. Those Water releases range, dizzyingly, from Terry Reid, the man who would have been Led Zeppelin’s lead vocalist had he been more career minded, to a recent series of majestic Milton Nascimento ’70s releases to Sonny Sharrock’s screaming early endeavors and the Flaming Lips’ Restless albums on pink, blue, and clear vinyl.

"There’s not one fucking record on there that isn’t interesting," says Patrick Roques, who has worked for Water as well as Blue Note. "Everything on the catalog, you want to have. It reminds me of Factory, growing up: anything you saw with that label, you wanted to buy it. All that music that came out on Water is important."

And in the recent years of industry downturn, the music has gotten lost while major labels have largely focused on reissuing albums digitally — sans the careful packaging and new liner notes that Runt takes pains to deliver — rather than physically. "The way the market is going for all labels and with fewer places to sell physical CDs, we can’t put out as many as we used to," says Mason Williams, A&R director at Rhino/Warner Bros., which made its name as an independent reissuer, continues to put out handsome reissues, and now works with Runt, among other indies. "More and more smaller labels have started in the last few years and are working with other labels to reissue deep catalog stuff."

"When I was a teenager [in the ’70s]," Thomas continues, "I could go to JC Penney and Sears and buy any album by the Stones or the Beatles or the Who from the classic rock back catalog. Now if you go Target or Wal-Mart, you’re only going to get ‘Best of’s. Even multimillion-selling bands — you can get the best of Led Zep, but you can’t get Led Zeppelin IV. This is forcing labels to tighten up their catalog because places like that aren’t ordering it." The closure of Tower, one of the biggest stockers of back-catalog albums, didn’t help. "Eventually, it’s going to reach a point that legendary items aren’t going to be available on CD."

That’s where Runt comes in. The latest Elliott Smith collection of tasty, previously unreleased scraps wafts through Runt’s spacious brick loft and warehouse as Salvadori burns me a copy of Water’s latest release, Judee Sill’s Live in London: The BBC Recordings 1972–1973, beneath a Dr. Seuss–like shadow man painted by staffer Nat Russell, who fronts Birds of America and runs Isota Records, which is also distributed by Runt. Life is beautiful, as the Roberto Benigni film title goes, on this sun-dappled day a few rolling blocks from the Parkway, and the man from Arezzo, the same small town the Italian dark comedy was set in, is talking about 4 Men with Beards’ upcoming vinyl releases of iconic albums by the Flying Burrito Brothers, Tim Buckley, John Cale, the Velvet Underground, Nico, the Replacements, and, as chance would have it, Smith — all with pricier gatefold packaging, if the LPs originally had it, and careful remastering at Fantasy. That sense of dedication reached its height with the release of Public Image Ltd.’s Metal Box on immaculately canned vinyl. "It was really crazy, but we really did it," Salvadori says, peering through thick black-rimmed spectacles as he picks up an original Metal Box, purchased off eBay and now significantly diminished in resale value thanks to the characters scrawled on its silver surface at the Chinese factory that duplicated it. The Runt crew procured the music rights from Warner Bros. before being told that the packaging permissions were owned by EMI/Virgin, which, it turned out, only had OK in the UK. Eventually John Lydon himself delivered the approval.

That journey — tracing a slab of decades-old wax on its manifold trajectories, to its multiple owners — is only one of many Salvadori has made. After his initial Cat Power success, he moved to Berkeley to study English in the mid-’90s. The touch-and-go world of struggling indies brought him back to Europe to distribute friends’ labels. Then, around 2001, Salvadori and his fellow collector-geek pal Thomas decided to take their major-label contacts and get into the reissue business themselves, beginning with such offbeat releases as the Holy Modal Rounders’ The Moray Eels Eat the Holy Modal Rounders and the Zodiac’s Cosmic Sounds. Licensing albums from labels like Rhino/Warner Bros. seemed mutually beneficial, Salvadori recalls: "For us it’s fine if we move a few thousand. Sometimes we get lucky and move more than several thousand, but for them it probably wouldn’t be worth it."

Water also seems to be sparking revivals in the music of Sill and Reid, who remain the label’s biggest sellers, as well as Ruthann Friedman, who began recording with Banhart and in early July had her first Bay Area show in aeons. Think of Runt, Water, and its offshoots as the logical extensions of your older sibling’s mysterious yet well-loved record collection, guiding you toward what you must listen to next, be it a cry from Albert Ayler, a Cluster and Brian Eno collabo, or a forgotten solo disc by Neu’s Michael Rother. Still, Salvadori hopes to someday get back to his roots, despite the costs and risks associated with nonreissues, i.e., newer artists, with … say, have you heard the Moore Brothers, on Plain? "We didn’t get too much luck yet, but I always hope the next record is going to be the one," he says. "They’re so good! So hopefully people are going to eventually say, ‘Hey, this is good.’ I always hope …" *

Compassion and Care Center employee and longtime medical marijuana activist Wayne Justmann proudly displays a framed "keep up the good work" letter from Speaker of the House Nancy Pelosi (D–San Francisco) in the second-story medical cannabis dispensary in San Francisco.

"Patients can sit and relax and get away from the problems of the world," Justmann told the Guardian in describing this half pharmacy, half community center, which features AIDS information brochures, a DSL Internet connection, the makings for peanut butter and jelly sandwiches, and marijuana priced at $18 for an eighth of an ounce.

The CCC, which has been open both legally and illegally since 1992, is one of the numerous medical cannabis dispensaries that are having a hard time getting through the city’s onerous approval process. Under guidelines that the Board of Supervisors approved and the mayor signed in November 2005, all of the dispensaries have until July 1 to get the required permits, but none have successfully done so.

The supervisors recently voted to hold off enforcement for the dispensaries that have already applied for permits, which 26 of the 31 or so clubs had done at press time. Pending legislation by Sup. Michela Alioto-Pier would set a new deadline of Jan. 1, 2008, while also effecting procedural changes that could make it difficult for many facilities to ever get permits. She is proposing more stringent disability access requirements and wants to give the Mayor’s Office more control over which clubs must abide by them.

Justmann and many others in the medical marijuana community interviewed by us see the pending legislation as a mixed bag. It would remove the police inspection from an approval process that now requires clubs to deal with six city departments, easing some concerns of proprietors in this quasi-legal business. Yet the legislation would also require all clubs to meet the Americans with Disabilities Act’s standards for new construction, which could prove logistically difficult and prohibitively expensive for most dispensaries, which are in older buildings. For example, the CCC would need to build an elevator in the aging building where it rents space.

Alioto-Pier told us the amendment — which will be heard by the Planning Commission on July 12 and the board thereafter — is necessary to place medical cannabis dispensaries on par with other medical facilities. "Specifically because they are medical, the board felt it’s important for MCDs to be accessible," she told us. "It’s what I think should have been across the city."

Under the amendment, dispensaries would have to ensure that their bathrooms, hallways, and front doors were wide enough for wheelchair access and that they had limited use–limited access elevators, which would disqualify vertical or inclined platform lifts. While dispensaries like ACT UP’s could aim to spend "tens of thousands of dollars" to meet the standards, co-owner Andrea Lindsay told us, others wouldn’t be able to comply, such as those that couldn’t afford the expense or whose landlords wouldn’t allow extensive remodeling jobs.

The CCC is accessible only by stairs and does not have the money or permission to do the work that the amendment would require. "Still, we provide the necessary services to the patient," Justmann said. He also cited the financial gamble in spending large sums on a business that — unlike other health care facilities — always stands the risk of being shut down by the federal government.

Stephanie (whom we agreed to identify only by her first name), an HIV-positive patient of the CCC for the past three years, told us the new accessibility standards could make affordable marijuana less accessible. "The places that will be able to be kept open will be price gougers," she said. "I won’t be able to afford it."

Some MCDs unable to meet the new standards could apply to the Mayor’s Office on Disability for waivers, giving Mayor Gavin Newsom — who has publicly said there should be fewer MCDs in town — more authority over medical marijuana. That arrangement would be a change from the procedure for other projects, which must submit waiver requests to the Access Appeals Commission, which is part of the Department of Building Inspection.

Kris Hermes of Oakland’s Americans for Safe Access expressed his skepticism about the switch. "The main concern of the people is that the MOD will have the ultimate discretion," he told us. But Sup. Ross Mirkarimi, who sponsored the Medical Cannabis Act in 2005, seems to be supporting the Alioto-Pier legislation. "It’s important that the MCDs are consistent with other health care facilities and businesses," he told us. "We want to do everything in our power to make this not so cost prohibitive."

No dispensaries have acquired a permit yet, although five now have "provisional permits." Many MCDs in the waiting line cite red tape and already stringent requirements as barring them from recognition as official businesses. Clubs must pay $6,691 for a permit and cannot generate "excessive profit" when in business.

"I don’t know what we need to do next," said Lindsay, who paid ACT UP’s fees six months ago. "The city’s new to the process. We’re new to the process. It’s frustrating on both sides."

For Kevin Reed, owner of the Green Cross Dispensary, meeting the new standards would be a hard task to accomplish in the next six months. As he told us, "You’d pretty much have to knock down a building and rebuild it."*

Dream girl

"I used to joke sometimes that I’m Judee’s last boyfriend," concedes Patrick Roques, producer of Dreams Come True, Water’s two-disc 2005 compendium of Judee Sill’s unreleased 1974 third album and demos. "I don’t mean to sound egotistic or anything, but I loved this woman like I’d love a girlfriend or wife."

Sill has that effect on listeners. Over the past few years, the onetime hooker, junkie, armed robber, bisexual reform-school girl, and all-around archetypal bad apple has realized the revelation visited on her while incarcerated in the Sybil Brand women’s prison: her music has been etched into the consciousnesses of passionate followers around the world who know her as a singer-songwriter of uncommon musical and metaphysical power. Even 27 years after her death from a cocaine overdose, it seems like Sill still hasn’t quite passed. Water has done its part to keep her musical reveries alive with the landmark Dreams Come True, mixed by Jim O’Rourke and including Roques’s obsessively researched, invaluable 68-page booklet and a 12-minute QuickTime movie of rare performance footage; reissues of her two Asylum studio albums, Judee Sill (1971) and Heart Food (1973); and the newly released Live in London: The BBC Recordings 1972–1973, an impeccably recorded document of Sill performing solo on acoustic guitar and piano, chatting with the audience and an interviewer, and in the process revealing snatches of a nervy yet nervous urban cowgirl in her blue-collar SoCal drawl.

For too long, before her rediscovery in recent years by a generation falling back in love with the folk songs of their parents’ youth, Sill was simply the lost girl from an age of singer-songwriters, a victim of her lack of stateside commercial success — though she’s been covered by artists ranging from the Turtles to the Hollies, Warren Zevon to Bonnie "Prince" Billy — and her will to transcend the bounds of the earth and everyday troubles, growing up in her father’s rough Oakland bar and later sexually abused by her stepfather. Clues to map out her art — or potential escape routes, which included a brief stay in Mill Valley’s Strawberry Canyon — were found in the sacred texts and music of Rosicrucianism and other forms of Christian mysticism, her studies of Pythagoras’s music of the spheres and occult modes like numerology, or simply the moment’s drug of choice, whether it be a daily tab of acid or the $150-a-day heroin habit that led her into prostitution and eventually check forgery.

Her decision in prison to devote her creative efforts to songwriting led her to truly reach for the sublime, in the form of songs that still touch listeners’ cores. Always-immaculate intonation, a deft sense of harmony, and elegantly composed songs informed by AM radio, folk, R&B, blues, gospel, and classical music were framed by Sill’s own arrangements, leading competition like Joni Mitchell to stop by and check out the Heart Food sessions. "I defy anyone who’s a high school dropout ex-junkie reform-school person to do that," Roques declares. "This woman was brilliant and plugged in — she had the energy, and it flowed through her." If you want to know and love Sill, she is, remarkably, still available — her spirit can be found all over her music.

So why didn’t Sill become a household name like Asylum labelmate Jackson Browne? "Judee didn’t get along with [Asylum head] David Geffen, and David Geffen isn’t someone you give shit to," Roques says. After recording two moderately successful LPs, "she was in debt to him, and Jackson Browne came along, and he was just easier to deal with, I think, from a corporate perspective. Browne hung out in the close inner circle and had hits. She didn’t hang out with the Asylum record crowd too much. She hung out a little with Linda Ronstadt and the Eagles, and she had a lot of strange friends that she had had for a long time in LA."

One of Sill’s exes and old pals, musician Tommy Peltier witnessed the disconnect between the worlds Sill ran in and remembers accompanying her to a Warner Bros. Christmas party right after her debut came out. "We went in my beat-up old car to the Beverly Hills Hotel, and that was first time I saw her cringe," recalls Peltier, who first met Sill onstage at a 1968 jam session ("It was love at first song"). "Here she was the new starlet — there were all these Rollses and limos, and then this clunker drives up, and the new starlet comes out! That was the only time I saw her really uncomfortable, but she just went in there and took over the room."

But as difficult or out of her element as Sill could be, she was within her rights to complain about her handling when she went from opening for kindred souls like Crosby, Stills, and Nash to fronting rock bands. "If you listen to the BBC sessions, she talks about lower chakras and people who just want to boogie, and it’s true," Roques explains. "The rock crowd just wanted to drink wine and take mescaline and get fucked up and party, and there’s Judee singing ‘Jesus Was a Cross Maker’ and making references to esoteric literature. People who went out for a Friday night didn’t want to hear that, just like they didn’t want to hear Charles Mingus. Americans just want to partay — that’s cool — but that’s why she did better in England."

It’s no surprise, then, that Sill obsessives like O’Rourke and Roques still feel protective of her, careful about sharing their love for the dark lady of a sunlit Topanga Canyon whose revelations were forged on the grittily glamorous, sadly battered streets of Los Angeles and who, ironically, seems a perfect fit for yet another turn through Hollywood. "She was out there on the edge," Roques says, "and though I don’t think she ever talked about women’s lib, she was a very ballsy chick and knew what the fuck she wanted and just went and did it. And she evolved into a fantastic person — there’s no one like her" — although, apparently, listeners keep looking. "I search for tapes and talk to musicians endlessly," he continues. "And if you go on these sites, you’ll see everyone wants to find the next Judee Sill — and none of them can even touch Judee Sill." *

Dr. Rock feels your fashion-free pain and took up the issue with the party starters of Gravy Train!!!! Not for nothing did the Bay Area raunch peddlers title a tune off their new album, All the Sweet Stuff (Cochon), "The Hair Stare."

1. "Making the audience uncomfortable is a good place to start," vocalist Chunx says. "All the bands that were most memorable to me growing up were either awkward or androgynous or exuded something that made me so uncomfortable that it led me to become intrigued. Rock stars should always seem superhuman. Or alien. If you can imagine them eating breakfast, you’re probably not doing it right."

2. "I would start with fashion," says keyboardist Hunx, who also styles hair at Down at Lulu’s in Oakland. "You need to get a look down or matching outfits or at least have a theme." Absorb the high-camp retro swank of artists like the Bay City Rollers and Slade on DVD and study old dance shows to cop ideas and moves. "We don’t get inspiration from new bands," he adds. "People just dress like their neighbors. But even matching T-shirts is a start."

3. "I always like props," Chunx raves. "I think Alice Cooper beheading people on stage was genius!"

4. "This probably comes as no surprise, but I’d always advocate any overt sexuality," Chunx says. "It’s the cheapest way to go, but people like to see people get naked and overtly, crazily sexual onstage. No one’s going to want to look away — even if it’s the car-accident syndrome!"

SONIC REDUCER Anyone who’s thumbed through the oodles of zany organ, squealing chipmunk, and queasy-listening albums from the ’50s onwards knows this to be true: every generation has its version of Muzak, whether its members like it not — thanks to clueless parental units. And the class of 2025 will undoubtedly have vibe ‘n’ synth instrumental renditions of "About a Girl," "D’yer Mak’er," and "Cherub Rock" dancing in their heads — no thanks to the Rockabye Baby! series on Baby Rock Records that appears to be multiplying like bunnies monthly. What next — sleepy-time Mentors? But what would baby lend an ear to once he or she started dabbling in books, student-body politics, and witchcraft? In other words, WWHPLT — what would Harry Potter listen to?

Boston’s Harry and the Potters have been working off that premise for the past three years, touring the country’s finest libraries. After outgrowing San Francisco’s main library and drawing several hundred to their show at the Civic Center last year, they’ve decided to get booked, adult-style, at Slim’s, alongside Jurassic Park IV: The Musical, which dares to pick up where the last dino blockbuster left off.

So, I tease, you’re doing a real tour this time? "Why is playing libraries not a tour?" the older, seventh-year Harry, Paul DeGeorge, 28, retorts by phone as he hauls T-shirts into the cellar of the Tucson Public Library, the site of that night’s show. "It’s actually a lot more work, because we set up our sound system every day."

He may be playing in a basement, but DeGeorge and his brother Joe, who appears as fourth-year Harry, aren’t playing to our baser instincts. "I thought this would be a great way to play rock to a whole new audience that doesn’t experience that," he explains. "If Harry Potter had the cool effect of getting kids to read more, maybe we can get kids to rock more too!"

The proof is in his now-20-year-old sibling. DeGeorge started feeding his younger brother Pixies, Nirvana, They Might Be Giants, and Atom and His Package CDs when the latter was nine, and apparently the scientific experiment paid off. "I could see the effect immediately. By the time Joe was 12, DeGeorge says, "he was writing songs about sea monkeys that referenced the Pixies" — and popping up in the Guardian in a story about early MP3.com stars.

And what about the silly kid stuff on Baby Rock Records? "I’d rather hear the original songs," DeGeorge opines. "Instead of Nine Inch Nails for babies, I’d just make a good mixtape for my baby. You can do ‘Hurt’ and just lop off the ending. It’s supereasy — anyone can do it!" Read it and weep, Trent.

SERPENT SPIT "So the proctology jokes remain." Thus came the news from filmmaker Danny Plotnick that Nest of Vipers, his freewheeling podcast highlighting the wit and storytelling chops of such SF undergroundlings as Hank VI’s Tony Bedard, the Husbands’ Sadie Shaw, singer-songwriter Chuck Prophet, and Porchlight’s Beth Lisick, was now officially off the KQED site and fully independent (and available through iTunes). "I had a contract for six episodes to be distributed by KQED," Plotnick e-mailed. "Ultimately they released eight episodes. They didn’t renew the contract because the show was too edgy for them."

Unfortunately, that also means the customer-service episode that triggered those treasured proctology-convention yuks, which was supposed to go up on the public station’s Web site on June 15, has been delayed till July 1 as Plotnick figures out new hosting.

But at least the assembled vipers will continue to writhe unchecked. Inspired by Plotnick’s favorite sports talk shows, Nest of Vipers aims to issue a weekly breath of venomous, randomized air in an ever-constricting radio landscape. "So often on radio there’s a bunch of experts pontificating about whatever," he told me earlier. "This is more about real people talking about real experiences," or like hanging with the gritty raconteurs at your favorite dive bar. The next episode, for instance, sounds like a doozy: Bucky Sinister talks about working the phones at PlayStation on Christmas morning, and Bedard has a yarn about biting into a Ghirardelli chocolate bar and finding a maggot — thinking it’s his big payday, he returns it to the company. You have been served! *

It was a week of triumph for workers and union activists opposing the conservative agenda of the owner and operators of the Emeryville Woodfin Suites hotel.

The Guardian last week ("Calling in the Feds," 6/13/07) revealed that the hotel called on its owner’s political connections to blow the immigration whistle on housekeepers involved in a campaign to enforce a living-wage law at the Woodfin. That revelation came a day after Emeryville city officials ordered the hotel to pay $125,000 in back wages and $31,500 in fines for failing to show it was paying adequate wages.

The Woodfin chain has fought the living-wage law, Measure C, since even before voters approved it in 2005, originally refusing to comply. Then the Woodfin Suites fired workers who were organizing to enforce the measure, claiming they were undocumented immigrants. After being ordered by the city to reinstate the workers, hotel officials claimed the firings were justified by an April immigration audit by Immigration and Customs Enforcement (ICE).

The Guardian found that US Rep. Brian Bilbray (R–San Diego) asked ICE to investigate the hotel after a representative of the Emeryville Woodfin Suites — whose president, Sam Hardage, has close ties to Bilbray — contacted his office for assistance Feb. 1. That revelation was at the center of a June 13 rally at the Oakland Federal Building by members of the East Bay Alliance for a Sustainable Economy (EBASE), which helped pass Measure C and supports the laid-off workers.

"It is now clearer than ever that [the Woodfin’s] real motive was to get rid of workers who were standing up for their rights," organizer Brooke Anderson said through a loudspeaker.

Among those at the rally were Berkeley City Council member Kriss Worthington, Emeryville City Council member John Fricke, and representatives of California Assembly member Sandré Swanson (D-Oakland) and US Rep. Barbara Lee (D-Oakland).

Lee’s district director, Leslie Littleton, said Lee was "proud to stand strong with the Woodfin workers in support of their continued fight for the back pay that they are owed," and cited Lee’s "strong opposition to the ICE raids that have been terrorizing our community."

Littleton also said Lee was "deeply concerned by the allegations that another member of Congress — acting on behalf of a campaign contributor — may have gotten a federal agency to intervene in that dispute in a way that hurts workers in my district."

Emeryville special counsel Benjamin Stock told the Guardian that letters between Bilbray and ICE located as a result of our article will be cited in a pending lawsuit charging Woodfin officials with retaliating against whistle-blowing workers. It is against the law for an employer to fire workers for organizing for better working conditions, regardless of immigration status.

In a prepared statement, Woodfin officials said they contacted Bilbray’s office "to be certain we were in compliance with all laws governing our business." They claim that Measure C’s regulations "directly contradict federal immigration laws and violate the Constitution’s due-process clause." Both of the Woodfin’s federal lawsuits challenging Measure C’s constitutionality have been rejected; the last was dismissed June 7.

Emeryville has already spent hundreds of thousands of dollars litigating these two federal court cases and a pending state court case and processing worker complaints. The Woodfin now says it will appeal the city’s decision regarding back wages. City officials are urging the Woodfin to accept defeat.

"Please," Emeryville City Attorney Mark Biddle said, "let’s move on with life. Measure C is a pretty simple concept, and all the other hotels seem to be on board." The Woodfin, he told us, can "either keep fighting a useless cause and continue ringing up the bill or pay the workers what the law requires."

The Queer Issue: Rainbow retirement

Lionel Mayrand spent more than a decade working with the elderly. He helped train staff for the National Meals for the Elderly Project and wrote the first grant application for Elderhostel, an international senior travel network. Along the way, Mayrand found and lost one of the great loves of his life. "I am an AIDS widower," he says. "My financial life was wiped out by the illness of my partner in life and business. I lost so many friends to AIDS, I’m starting to forget their names." Recently, the sixtysomething tax specialist noticed the Senior Services meal program located near his house and suddenly found himself wrestling with the idea of attending. It was not so much a matter of pride or of realizing his age, but of community. With his unique life experiences, would he feel welcome?

QUEER PIONEERS


Getting older is a challenge for many people. But retired LGBTs often face unique difficulties. They feel a sense of isolation and discrimination — more hurdles for a group that weathered straight hatred and the AIDS pandemic. There’s also a lack of established infrastructure particular to their needs: many LGBT people of the baby boom generation, which is just now hitting retirement age, had to leave their families behind in order to live openly, so they may not have an inheritance or traditional family support to turn to. And because AIDS left so few survivors of earlier queer generations, the health care system is woefully unprepared to meet current senior queer physical and psychological needs. In a way, today’s senior queers are pioneers.

"Queer seniors often lack the family support systems that older straights take for granted," says Michael Adams, executive director of New York–<\d>based Services and Advocacy for GLBT Elders, or SAGE. Now 29 years old, SAGE is the oldest and largest organization in the country focusing on the needs of LGBT seniors. "Many queers may have been disconnected from their birth families for many years, and they’re less likely to have had children of their own. Older queers are also likelier to live alone and less likely to be in relationships," Adams says.

Meanwhile, older queers also face more discrimination from senior organizations, nursing homes, and health care providers, he adds. Some groups, such as the Red Cross, are committed to discrimination for religious or philosophical reasons. In other organizations, individual staffers may just have an issue. Worst of all, "a lack of support in the LGBT community itself" exacerbates this problem, Adams says. "There’s ageism in every community, but when you’re talking about a population of seniors that faces such difficulty in the senior world," the indifference of the LGBT community compounds the problem.

Local organizations, however, are stepping up to provide the kind of help non-LGBT seniors might not get from their nuclear families or the gay community at large. The queer-oriented New Leaf Outreach to Elders in San Francisco offers 24 senior activities and 50 meetings per week at different sites around the city, as well as health and counseling services at its clinic on Hayes Street. And New Leaf isn’t afraid to use the past to help the future.

"The way in which the gay and lesbian communities mobilized to take care of the HIV pandemic has become a model for organizations taking care of straight people," says Bill Kirkpatrick, a New Leaf social services worker. Even mainstream organizations taking care of the elderly are learning from the queer response to HIV, he says. "As the epidemic created models for us to take care of ourselves, the same thing is happening in the aging community."

TAKING IT STRAIGHT


Accommodating the needs of queer seniors doesn’t mean reinventing the wheel, Kirkpatrick adds. A big part of his work at New Leaf involves helping LGBT people connect with traditionally straight, more established programs. "We want to make sure these services have been culturally trained," Kirkpatrick says. New Leaf takes LGBT seniors to staff meetings at organizations like Meals on Wheels and other home health care agencies so the seniors can tell their stories and educate workers.

But what about the seniors themselves? Kirkpatrick says a big part of his job is working to gain the trust of "someone who has survived by hiding from the mainstream services and is distrustful." New Leaf organizes volunteers to visit the homes of isolated seniors and check on them. The organization takes great care to avoid pathologizing problems like depression, isolation, and low self-esteem as if they’re strictly mental health issues, Kirkpatrick says.

SAGE provides many of the same services as New Leaf, but it also lobbies for public policies that are designed to advance the rights of LGBT seniors. "Too often, LGBT seniors have not been on the radar screen when it comes to the policies and programs that get developed for seniors at the state and national level," Adams says. In 2005, SAGE sent the first openly gay delegate to the White House Conference on Aging, an event that happens once every 10 years. "Those are the kinds of places where policy gets made, [and] funding streams and priorities get influenced."

SAGE also provides counseling on sexuality. The rate of HIV infection among older people is increasing, according to the National Institutes of Health. And recent studies have shown that HIV and other STDs are more likely to go undiagnosed in seniors because doctors assume older people don’t have sex or engage in other risky behavior.

Some seniors with HIV have been living with it for years, but others have acquired it recently. Many are taking advantage of the increased opportunities for sex thanks to Viagra — often without protection, Adams says.

A HOME OF THEIR OWN?


Another challenge facing LGBT seniors: when a same-sex partner dies, the surviving partner may not be able to inherit a pension or Social Security benefits. Transferring the title on a house can be more difficult for couples who aren’t legally married, notes Moli Steinert, executive director of Open House, a San Francisco nonprofit dedicated to building LGBT senior residences. Steinert is trying to get approval from the city for Open House’s first housing project, at 55 Laguna Street, part of a larger redevelopment project on that site. She says Open House is also in the process of identifying a low-income housing site. "Our mandate is really to develop mixed-income housing. You just can’t get housing all in one location for all populations, so we’re working on trying to find land that will lend itself to filling out the spectrum of needs in our community," she says.

Open House educates health service organizations about LGBT senior issues and reaches out to isolated queer seniors, similar to what New Leaf is doing. And Open House advocates for LGBT seniors at the citywide level, trying to make sure housing and other services are open to queers.

What exactly makes housing LGBT-friendly? According to Steinert, it’s a matter of making sure queer culture is represented and the staff is trained to recognize the needs of the population. For example, a transgender resident of a nursing home may need help with bathing and wouldn’t want an attendant who’s insensitive or transphobic.

"It would not be easy for an LGBT senior to feel at home in a traditional senior housing facility," Steinert says. "They would basically need to go back in the closet. They would not feel able to disclose their partner or their history and feel like it would be accepted." Even if you succeeded in training the staff to be sensitive, you might not change the culture among the people who’ve been living in the facility for years, she points out.

The first LGBT-focused housing facility for seniors in the Bay Area will probably be the Barbary Lane Senior Communities at Lake Merritt in Oakland. Preleasing began March 1, and people will start moving in this fall. The Barbary Lane team is transforming the classic art deco Lake Merritt Hotel into a safe space for seniors, doing everything from doubling the size of the elevators to using universal design to get rid of knobs and handles. The kitchens and bathrooms in the apartment units are designed to be easy to use for disabled people and people with arthritis or other mobility issues.

With the Parlor Suite starting at $3,295 and the Merritt Grand at $4,295, you couldn’t accuse Barbary Lane of being low-income housing. But these prices are typical for retirement communities, and they include meals and other amenities seniors would otherwise have to pay for separately, says David Latina, Barbary Lane’s president. "A schoolteacher could afford to live here," he adds. Hard-up residents could share a studio apartment, he suggests. Programming and activities will be queer focused, and Barbary Lane will try to involve the local queer community as much as possible, opening its lavish dining area to outside events such as queer weddings and fundraisers.

Barbary Lane will only house people who are mostly able to take care of themselves. Once they need more than an assisted-living level of care, they’ll have to move to a nursing facility or nursing home. When that happens, Barbary Lane will make sure they go to facilities that are LGBT-friendly and have well-trained staff, according to Latina.

Latina says his organization aims to open five more facilities in California and is partnering with another organization to open a facility in New York. There are 17,000 queer seniors in the Bay Area alone, Latina claims, and even if only a quarter of them are looking to move into retirement homes, that could mean more than 4,000 residents for places like Barbary Lane. Rainbow flags flying over retirement communities could become a common sight in the near future.<\!s>*

Revenge of the nerds

"Hey, everybody, we’re all gonna get laid!" Rodney Dangerfield’s character, Al Czervik, says in one of the classic lines from Caddyshack. Oakland’s Replicator sample the line as the tag end of "Delicious Fornicake," the opening track of their new album, Machines Will Always Let You Down (Radio Is Down). The inclusion is telling: Caddyshack celebrates the redemption — nay, triumph — of the little guy, the lowly, the nobody, the nerd, the caddy, for chrissakes, despite the oppression of greedy, classist boors. Machines is, in its way, a tight, terse, aggro, nerd-rock opera, with tweed cubicles replacing expansive set pieces, and hard, noisy post-punk reminiscent of geek-rock kingpins Big Black, in an alternate universe where Steve Albini doesn’t take himself so seriously. "It’s kind of, for lack of a better term, big rock," vocalist-guitarist Conan Neutron says over the phone from his apartment. In the opening track, the narrator, with the help of "a few beers, some Scotch, and a pack of cigarettes," builds "a robot with which to have sex." In "Payment www.yzzz.rd" (pronounced "wizard"), Neutron, an IT guy for a "major financial institution" when not living the rock ‘n’ roll lifestyle, sings, "I just got paid / So come get my cash / Come take my money / Come get it fast," the refrain of wage slaves everywhere.

The next track, "Assloads of Unrespect," is in the voice of a degenerate dot-com millionaire, the kind who crawled the Bay Area like a new species of roach in the mid- to late ’90s: "Let me begin / By saying I’m rich / I’m well-dressed / Good-looking / Hey — ain’t that a bitch? / Because I own you / That’s right, I own you." In an example of Neutron’s biting, often hilarious lyrics, the boss we love to hate goes on: "I heard it said the meek shall inherit the earth /Well, just make damn sure to shine my shoes first." The album goes on to tackle such subjects as time travel, the Enigma machine, and the spy-versus-spy uses of nanotechnology, before ending with the Office Space–like "Login with My Fist" — the battle cry of cubicle commandos everywhere — which winds down in a cacophony of screams and guitar squall, an implacable Commodore VIC-20–style voice repeating, "It does not compute," in the background.

It’s worth noting that the disc isn’t a celebration of all things techie, often a nerd stereotype. Rather, it’s a scathing denunciation of technology, or, more accurately, the devious and inhumane uses that technology has been put to in the hands of the powerful and ethically impaired. When the nerd class stops letting itself be pimped out for the glory of so-called pure science, then maybe it’ll inherit the earth. And when people stop being enamored of machines making life easier, maybe they’ll realize they’re being enslaved by technology — that, indeed, machines will always let you down.

"We make music for very pissed-off smart people," Neutron says. He goes on to acknowledge that this target demo is a small slice of the music-listening public: "Our music isn’t very popular." Formed in 1999, Replicator — Neutron, Ben Adrian on bass and keyboard, Chris Bolig on drums, and "junior partner" Todd Grant on guitar — have seen trends come and go. "First everyone was really into indie pop," Neutron says. "Then everyone was into sounding like Radiohead and then garage rock and then everyone wanted to, like, wear a mask and not really play music."

Through it all, Replicator have released three pissed-off, smart records, toured heavily, and brought to mind a time "when it was not an insult to be considered brilliant," as the lyric on "Login with My Fist" goes. I’m not saying they’re brilliant — nor am I saying they’re not — but what they’re attempting doesn’t accept mediocrity. This uncompromising approach often seems to have relegated them to the middle slot of shows while the underground flavor du jour headlines above them. Like Dangerfield, they get no respect.

One of the titles kicked around for the new album was Fuck You, Still Here. "I see bands that are more careerist," Neutron says. "They have this idea: ‘Oh, we’re going to get signed and then we’re going to make this video and go on tour with this band.’ That seems to be their end goal.

"Our end goal is to return the ass-kicking that music has given us."

SONIC REDUCER "Fuck Lars Ulrich — he can play drums on my balls with his teeth!" Them’s fighting words from the beefy bruiser in a tinsel page-boy wig, perhaps provoked only by four wannabe skids’ burning need to cover Metallica’s "For Whom the Bell Tolls" at last week’s first but — fortunately for your inner and outer sketched-out Priest hooligan with a nonironic mullet, prematurely weather-beaten mien, and herbally truncated short-term memory — not last "Hesher" night at the Parkside, where it’s now semiofficially installed after starting its smokin’ life at Annie’s Social Club. Still headbang or nod out to "Sweet Child o’ Mine"? All is forgiven and even drunkenly applauded at "Hesher," a metal karaoke and air guitar contest. Yet as delightful as it is to rock out with your crock out to such unrepentant cock-rock versions of "Eye of the Tiger" and "Round and Round," I couldn’t help but think that all of us ruddy walleyes were just cruising upstream against a current zeitgeist hell-bent on nailing culpables caught with their greasy paws in the cookie jar. How else to explain the crowds crowing to punish Paris or throw the book at I. Lewis "Lemme Scoot" Libby? Why else were latently Catholic viewers so outraged that Tony Soprano didn’t go down in a hail of bullets rather than simply cutting to black? After years of the Bush and Cheney show, the hordes have become less hesher than harsher.

Maybe we’re waiting for justice, answers, something to believe in — and perhaps the once-wronged and now recognized and fully redeemed Spoon’s Britt Daniel is ready to give it to us, just as he and other indie savants like Feist turn in their subtlest, slowest-growing recordings to date. In fact, the opening track of Spoon’s Ga Ga Ga Ga Ga (Merge), "Don’t Make Me a Target," could serve as the theme song for a rockin’ version of Chicago starring the most hated Hilton in America: it soft-shoes the bristly snarl of "Waiting for the Kid to Come Out," off last year’s reissued Soft Effects EP. In spite or perhaps because of the troubles he saw when he was pushed off Elektra, griping loudly all the way, Daniel has always sounded like one of the angriest dogs on the lot, barely leashed to those leathery pop hooks.

With Ga Ga Ga Ga Ga, Daniel ventures into other textures and tempos, moduutf8g his bark and bite with plangent pings and drastic pressure drops, floating in an echoey "The Ghost of You Lingers" and snapping suavely to the hand-clapping "Don’t You Evah." Though the infectious brass, Daniel’s streetwise taunts, and the band’s pugilistic punch conjure up memories of a certain cheesy piano man, as Sasha Frere-Jones of the New Yorker has pointed out, aligning "The Underdog" with Billy Joel’s "Only the Good Die Young," I’d venture that Daniel is less conjuring stereotypically cornball urban bluster pop straight out of some tourist fantasy of a Little Italy than continuing the same cranky conversation that began back around the hard-assed, grunge-era Soft Effects, now aged artfully into a modern-day Bobby Darrin–y hep cat. Much like the album’s cover girl, sculptor Lee Bontecou, Daniel’s finding new mettle — and much softer metals — with which to channel his rage.

FOLKLORE LURE Court and Spark and Hiss Golden Messenger honcho and teacher MC Taylor is answering the siren call of higher education and leaving the Mission digs he shares with his wife, Abby, to move to Chapel Hill, NC. "We both wanted a change of scenery, wanted to live in the country and have a garden. I got accepted to the grad program in folklore at UNC, so everything worked out perfectly," he e-mailed on the eve of a moving sale that promised "the craziest set of Dungeons and Dragons role-playing game books that you’ve probably ever seen — seriously." Taylor will continue the more improvisational HGM in his sweet home North Carolina, though sadly C&S will probably call it a day — but not before a finale July 6 at Cafe du Nord.

MICKI ON THE MEND? Many know Stork Club owner Micki Chittock as the Oaktown stalwart who moved the Stork from its cubby near the Tribune tower to its current Telegraph Avenue clubhouse. But how many, booker Joel Harmon wonders, have come through for Chittock since her serious van accident in April? Suffering from a broken femur, pelvis, back, and ribs, Chittock has three weeks left in intensive care before she’s transferred to a recovery room, Harmon e-mailed me, after doctors gave the club owner a 50 percent chance of recovery. Harmon has put together two benefit shows to ease the medical expenses, and he’s working on more because, he writes, "I’m thinking that in order for the Stork to survive, Micki has to survive." *
