Steel crazy

Imagine that Supermans III and IV never happened, and that in Superman II Lois Lane never realized that Clark Kent was really the Man of Steel disguised in a pair of dorky glasses. (The part about Lois and Superman knocking boots, however, still stands). Now you’re up to speed on Superman Returns, whose title reflects the film’s story — after a five-year outer space sojourn, Superman (Brandon Routh) heads back to Metropolis, to the consternation of ex-sweetie Lois (Kate Bosworth) and supervillain Lex Luthor (Kevin Spacey) — as well as the film itself, which like Batman Begins heralds a return to cinematic form for its title character. The result may not be as giddily triumphant as Spider-Man 2, but all told, the 21st century is officially a damn good time to be a superhero.
Director Bryan Singer (X-Men) is clearly a huge Superman fan; Superman Returns takes its subject very seriously. With two and a half hours to fill, all the cool super-shit you want to see (X-ray vision, bulletproof body parts, swooping around with one fist extended, etc.) is in there, plus plenty of iconic moments. (Marlon Brando’s Jor-El makes multiple from-beyond-the-grave appearances — and has the cry of “Great Caesar’s ghost!” ever before inspired audience applause?) Needless to say, Superman Returns’ superbudget (imdb.com estimates it at $260 million) spells jaw-dropping special effects. Sure, you’ll believe a man can fly, but you’ll also believe a man can stop a fiery airplane from smashing into a baseball stadium.
The effects can get out of control, though — the climax, which takes place partially underwater, drags a bit despite looking great. At least by the time we get there, all of Superman Returns’ hard work building sympathetic characters pretty much pays off. The film’s intertwining story lines follow Superman as he dons Clark Kent garb at the Daily Planet and wistfully yearns for Lois, who’s semi-happily settled down with nice guy Richard (perennial third wheel James Marsden). Oh yeah, and she has a scraggly-haired five-year-old who may or may not be half-Kryptonian. Meanwhile, bald baddie Luthor is out of jail, ridiculously well funded, and as set on world domination as he is on knocking Superman out of the sky.
The Luthor stuff inevitably supplies the film’s comic relief, thanks to Spacey’s manic performance and certain weird touches (like sidekick Parker Posey’s time-warp wardrobe and a running gag about a Pomeranian). And if you’re looking for correlations between Superman Returns and current events, try Luthor’s plan to destroy the United States — eagerly reported on by Metropolis’s version of cable news. (In the 21st century, the Daily Planet stays afloat thanks to this editorial mission: “There are three things that sell papers: tragedy, sex, and Superman.”)
Of course, the main conflict in Superman Returns doesn’t even involve Luthor: It’s whether or not Lois will forgive her super soulmate for abruptly skipping town. (You know how all that tension between Spider-Man and Mary Jane kind of overshadowed the Doctor Octopus shenanigans? Yeah, it’s like that.) The film’s overriding theme, though, is of fathers and sons. Not for nothing does Brando keep popping up, reinforcing the idea that Superman (Jor-El’s “only son”) was sent to Earth to save humankind — a concept that everyone on earth pretty much buys, including, eventually, the bitter Lois (author of a Pulitzer-winning editorial titled “Why the World Doesn’t Need Superman”). But even if you ignore the religious metaphors and check your watch during the mushy relationship bits, it’s hard not to get summer movie thrill-chills when John Williams’s familiar theme (recycled here as part of John Ottman’s score) plays under the swooshing title credits. Absolute perfection, maybe not — but super’ll do. SFBG

The local daily newspapers haven’t paid much attention to it, but there’s a ferocious fuss going on in the blog world over political power and journalistic ethics, and it’s all swirling around a 34-year-old who runs the world’s most popular political blog out of his home in Berkeley.
It’s a fascinating story because of what it says about the revolution that’s taking place in media and politics today.
Markos Moulitsas Zuniga runs the blog DailyKos, which started off as just another liberal political blog by a liberal political activist (who used to be a political consultant and worked at one point for Howard Dean). But in the past three years it’s become phenomenally successful: DailyKos.com gets about a half million page views a day, which puts it in the league not with most of the other blogs but with major mainstream news operations. Moulitsas has no staff — no reporters, no editors, no reviewers, no nothing. His readers — or, more accurately, the members of the huge and growing DailyKos community of 92,000 registered users — provide almost all of the content. They write their own personal blogs called diaries, they comment on each other’s stuff, they promote (and dis) candidates, and they have formed the best known place in the country for the Dean wing of the Democratic Party to meet and confer.
The politicians have noticed, big time: Leading Democrats (like Rep. Nancy Pelosi) post on the site. A couple of months ago, a former president (Jimmy Carter) stopped by to blog. When the Kossacks organized an annual convention this summer, Sen. Harry Reid and presidential hopeful Mark Warner showed up.
So now DailyKos is in the big leagues — and not surprisingly, critics are starting to snipe.
The latest: Moulitsas and Jerome Armstrong, who runs MyDD.com, have written a book together, and are longtime pals. (Moulitsas calls Armstrong his “blogfather.”) Armstrong is an active political consultant, and the candidates he works for sometimes get nice mentions on DailyKos. There’s been a lot of mumbling about how there might be some kind of sordid conspiracy here (hire Armstrong, get plugged on DailyKos), and it all became louder when the New Republic got word that Armstrong had been accused of illegally hyping stocks on the Web several years ago — and that Moulitsas had sent an e-mail around to a private mailing list urging other bloggers to keep it quiet.
The right-wingers (including David Brooks of the New York Times) have had a field day with this, acting as if they’ve finally unmasked the Great Left-Wing Conspiracy. Actually, the fact that it all came out in the open pretty quickly shows what a lousy secret cabal the bloggers make. Mostly, Moulitsas’s e-mail was just pretty stupid. But the whole episode raises the question: At what point do bloggers have a responsibility to be accountable, to have ethics and disclosure standards the way “mainstream” journalists are supposed to?
I e-mailed Moulitsas about it, and he’s pretty clear: “People like you keep trying to pound a round peg into a square hole,” he said. “This is citizen media. It is what it is … Old media might want the media landscape to resemble their old world, but it doesn’t, not anymore.”
Which is absolutely true. And I love DailyKos. And the blog explosion is perhaps the most democratic thing that’s happened to media in the history of civilization.
But at some point, citizen journalism isn’t enough — you need reporters and editors and a real staff to give the public real information about the world. And when that happens in the blog world (and it will soon) a lot of the rules are going to change. SFBG

For bicyclists, some good news…

San Francisco’s southeastern waterfront is a natural jewel buried under the city’s industrial past.
The coastline is warm and often beautiful but marked mostly by collapsing piers, rusting skeletons of industrial centers, two power plants, and other long abandoned maritime projects.
But city and port officials, with the support of civic groups, are embarking on an ambitious effort to open up the waterfront with new bicycle and pedestrian trails, rotating public artwork, improved aquatic access, spruced up waterfront parks, rebuilt piers, and the transformation of industrial property into public spaces that would teach visitors about San Francisco’s past.
The recent opening of Pier 14, with the Passage sculpture from last year’s Burning Man festival as a temporary centerpiece, was a big step forward. And the imminent announcement of what the Farallon/Shorenstein development team is proposing for Piers 27–31 will be another important piece of the central waterfront puzzle.
Yet it is the so-called Blue Greenway initiative — which was formally launched June 24 with a bike and boat tour ending with a party at India Basin Shoreline Park on Hunter’s Point — that takes on the toughest terrain: the 13-mile coastline stretching from China Basin all the way down to Candlestick Point.
A Blue Greenway task force was set up six months ago by Mayor Gavin Newsom and Sup. Sophie Maxwell, with support from the Livable City Initiative and Neighborhood Parks Council. They shared their vision with a group of almost 100 bicyclists on a guided tour led by Newsom’s director of greening, Marshall Foster.
“We’re still imagining the way,” Foster said at the first stop of the Imagine the Way tour, Aqua Vista Park, where artist Topher Delaney is still covering the pier in shimmery blue sequins and installing horizontal bike rims trimmed with reflectors at the tops of colored poles.
Another art installment planned at Third Street and Cargo Way, Red Fish by William Wareham, was also not yet complete, like much of the Blue Greenway.
“You’ll notice on Illinois Street how there were no bike lanes. There were supposed to be bike lanes,” said Foster, noting how that project was recently appealed to the Board of Supervisors, only to have that and most other bike projects around the city stopped by a judge’s injunction (see sidebar).
At Pier 70 — once the main employment center of San Francisco, first with Union Iron Works and later Bethlehem Steel — getting access to the waterfront is nearly impossible now. The buildings are dangerous ruins and only broken pilings remain from the once-bustling piers.
“We think ultimately we can get in here and get access to the waterfront,” Foster said.
The Port of San Francisco’s planning and development director, Byron Rhett, who was also pedaling along on the tour, supported Foster’s hopes and said the port has consultants analyzing the site.
“We are just starting the process of declaring this an historic district,” Rhett said. “Bicycle and pedestrian access will be part of those discussions.”
Just south of Pier 70, the tour wound through the weed-strewn and graffiti-covered shoreline park and pathway at Warm Springs Cove. “This is a park that needs love,” said Michael Alexander, an historian and task force member who helped Foster narrate the journey.
A group of eight kayakers who were shadowing the bicyclists showed up while Alexander was talking, and he explained that there will be improvements to water access for them, both at Warm Springs and the next stop, Islais Landing, which was once a busy deepwater port channel, but which is now mostly hidden from view by roadways and underground culverts.
“We want to create places where we can open up Islais Creek,” Foster told the group.
The final two spots of the tour were on either side of the recently shuttered Hunter’s Point Power Plant: Heron’s Head Park and India Basin Shoreline Park, which are connected by a coastal trail that most San Franciscans probably don’t know exists.
At the final stop, Newsom, Maxwell, Assemblymember Mark Leno, and other luminaries gathered to promote the project.
“The Blue Greenway is already in each and every one of us, and we’re going to make sure that dream comes true,” Maxwell said.
The project will be a public-private partnership. Newsom committed the city to the effort but said the public has to get involved: “Without getting the enthusiasm to pull this off, it won’t happen.” SFBG

Taking spills

It takes a lot to knock an obsession out of Built to Spill singer-songwriter-guitarist Doug Martsch. Behind the beard, the down-low home life with wife and child, and the phone conversation padded with softly undercutting “Oh, I dunno’s,” once lay the heart of a raging pickup basketball junkie.
“I kinda got sucked into the NBA play-offs seven or eight years ago,” explains Martsch, 37, from his home in Boise, Idaho. “Then I quit smoking cigarettes five or six years ago, and when I quit smoking, I decided to go shoot hoops, and then I just got really addicted to it, totally loved it. That was kind of my main passion.
“Yeah, I played music somewhat, but basketball was what I lived for and did every day.”
A seemingly harmless hobby, except that Martsch threw himself so vigorously into the game that he was starting to do some real damage — to himself. Most recently, Built to Spill — one of Northwestern rock’s most respected representatives and one of ’90s indie/alternative/modern rock/whatev’s most influential bands — had to push back the tour dates for their new album, You in Reverse (Warner Bros.), because of a detached retina Martsch suffered while banging around the court. And then there was the last time Built to Spill played in San Francisco, two years ago …
The band was staying at the Phoenix, and as usual while on tour, Martsch ventured out, looking for a local pickup game. He found one at the Tenderloin Golden Gate YMCA. “I was playing noon ball with the people there, and I got smacked in the ear and popped my eardrum, and I was deaf in my right ear for a couple months,” he recalls. “I kept waiting for my hearing to come back. We had to finish the tour, and I could only hear out of one ear, and it was driving me crazy!” After he returned home Martsch finally, reluctantly broke the news to his wife, who had been worried about basketball injuries for some time. One can imagine the I told you sos ringing out all over Boise.
“Yeah, I had my right ear destroyed, and my right eye destroyed so far, and my right knee also,” continues Martsch, who, at one point, also suspected he had a torn ACL. “So, I dunno — I’m about done. I also started taking it a little too seriously. I started not having very much fun unless I was playing well. If I missed a few shots, I’d just become really frustrated, and I wasn’t really enjoying myself.” After his eye injury Martsch followed his doctor’s orders to stop playing for a few months, and in the process, some of the fixation dissipated (though plucky challengers can get a taste of it by playing Martsch via a game on the band’s Built to Spill Web site).
Luckily for patient Built to Spill fans, Martsch reimmersed himself in music. Those listeners had been waiting for five years for a studio follow-up to Ancient Melodies of the Future (Warner Bros.). Touched by Martsch’s passion for the Delta blues — which resulted in his 2002 solo album, Now You Know (Warner Bros.) — You in Reverse finds the band shaping less characteristic jams and experimenting in the studio, sans their longtime producer Phil Ek and accompanied by only engineer Steven Wray Lobdell (who ended up getting the producer credit). Pitting himself against longtime contributing guitarist–turned–permanent member Brett Netson of Caustic Resin, Martsch unfurls guitar solos that are both economical and impassioned, beginning with the lengthy, multitextured suite “Goin’ Against Your Mind.” He buries his vocals as guitars chime brightly in the foreground on “Liar,” then throws indie listeners for a loop with souped-up ska and flamenco tempos (“Mess With Time”). In all, Martsch sounds more like a ’burb-bound Neil Young than ever before, harnessing a semi-tamed Crazy Horse for his garage jams with his Seattle- and Boise-based bandmates while sidestepping the dangers of repeating himself and working in almost undetectable jabs at the current political environment.
Looking back at the gap between Ancient Melodies and You in Reverse, Martsch is quick to point out that the band actually took only a yearlong breather between tours and recording. But the reason they took the break, he confesses, was that “I just really burned out. I was just kind of tired of Built to Spill and wasn’t very interested in alternative rock in general.” He discovered Delta blues around the time he recorded Keep It Like a Secret and, he explains, “that’s all that sounded very good to me.”
That changed when the group got together to jam for You in Reverse, which Martsch describes as Built to Spill’s most collaborative album yet. He hopes with the official addition of Netson that he can write songs with the rest of the band while Built to Spill is on tour and recording songs at studios across the country. “I’m just kind of excited,” says Martsch. And that’s a major score for someone who claims he doesn’t think he has a “real lust for life.”

Amazing, but not unexpected: Steve Westly joined with Phil Angelides today in L.A. to announce a unified campaign for the fall. Westly, who had blasted Angelides for allegedly dumping waste into Lake Tahoe, called him ” a brilliant man” who is “comitted to environmental values.”
It was a good move for Westly to be gracious, but it’s a little late for that sort of thing: Schwarzenegger is already gathering up all the negative stuff Westly threw at Angelides, and we’ll see it all again in the fall.
The good news is that the voters will have already been exposed to this stuff once (and while it may have supressed turnout a bit, it clearly didn’t damage Angelides fatally). So when the Guv tries to bring it all up again — “Angelides wants to raise your taxes, Angelides got money from developers, Angelides is a dork,” whatever — the public will be sick of it.
Schwarzenegger is still very, very vulnerable, and will be counting on his big bond measure this fall to carry him. Already, he’s talking about how he wants to rebuild California for the future. The advantage Angelides has is that unlike Westly, he can point to some very clear and different policy positions. He’s not Arnold — and right now, that’s a big thing.

SUPER EGO Gurl, I woke up on the wrong side of Tuesday afternoon. I don’t know if it was that pint of Cuervo I ordered for appetizers the night before or that quart of quinine I downed soon after for the tetanus I got from sitting on someone’s iPod, but I was hella hungover. My jaw was swiveling, my heart was pounding, and my languid extremities felt so hot that the unicorns on my nails nearly melted. One minute I was hosting the World Cup in my fantasy bra and panties, the next I was hosting it in my actual head.

“This is it,” I thought through the shuddering echo of tiny cleats. “Mama’s gettin’ middle-aged.” I’d finally hit one of midlife’s big Hs: hot flash, hair loss, hangover. And I’m only 19! Good thing I carry some Remifemin and an extra wig in my beaded Whole Foods evening bag.

Fitfully I scanned the Dumpster for any half-smoked butts and chased my scattered thoughts to their grim conclusions. Folks think I’m frickin’ Carrie Bradshaw, being a columnist, lolling around in my Blahniks, whimsically riffing on the romantic wiles of my telegenic brunchmates, leaping with a shy giggle into the magical dilemmas of contemporary life. But this is clubland, Samantha: Dive too deep down in it and hey, presto! abracadrinkingproblem. Ain’t nothing wrong with a little party-party, y’all, but us clubbers gotta watch for that border cross over the Rio Messy: Shit’s about as tasteful as soyr cream on a tofurkey burritofu, but with almost twice the calories.

So, maybe it was time for a tiny hooch holiday. Me, I’m an uncurbed child of the streets, where “time-out” is code for “free clinic” (and “free clinic” means “trick’s bathroom”), but in my new semifully employed state I’m always running into vibrant-looking Guardian people taking “a personal time-out” from drinking, from smoking, from imported prickle-backed Peruvian shellfish, whatever. You’d think my health insurance here would cover hangovers, what with the professional risk involved in my line of work, but alas, “no dice.”

“You can do this,” I assured myself. “Just for a week. It’s not like when the government made you give up Wal-Trim diet pills. That was forever.

But just because I wasn’t drinking didn’t mean I wasn’t going out altogether. She’s still gotta earn a living, and her living’s spilling tea. Luckily, along with the current wine bar burst, San Francisco’s having a tearoom explosion as well. (No, not that kind of tearoom, perverts. Leaves first, then you pay not the other way around.) And the goddess of cups provides several venues for bar-hour tea-totaling glee. The slightly hoity-toity yet still chill Samovar Tea Lounge (www.samovartea.com) in the Castro is a bookish, cruisey mecca and just opened a Yerba Buena Gardens outpost to boot. Modern Tea (www.moderntea.com) has taken hold in Hayes Valley, with its stylish presentation and unequaled view of all the tipsy drag queens stumbling from Marlena’s down the street. Hang on to your saucers, ladies.

But the real news on the late-night tea front is the hip-hop-oriented Poleng Lounge. Yep, you read right, it’s a hip-hop tearoom. The kids from Massive Selector have transformed the former 1751 Social Club space into a Bali-inspired wonderland that also hosts performances by some of the top names in roots and electro (Ohmega Watts, Vikter Duplaix, Triple Threat). Poleng’s restaurant and tearoom opens to the public June 9, with a huge kickoff bash featuring Faust and Shortee, Amp Live, host Lateef, and probably more than a few chipped handles. Food and tipple are also available, but the focus, of course, is on the leaf green and otherwise.

Whew! After all that tea I need to take a leak. But before I saunter off, look at me I’m fantastic, I’m radiant, I’m slightly hypercaffeinated. I feel like I could do yoga in the street. Maybe I should do this personal time-out thing more often. As they say, the liver the better (just kidney!). Now somebody order me a damn mai tai already. SFBG

Dastardly dailies

Why oh why does San Francisco have such terrible daily newspapers? In one of the most progressive cities in the country, why must we be subjected to Carla Marinucci’s regular hit pieces on the most liberal candidate in any race on the Chronicle’s front pages, or Examiner columnist Ken Garcia’s sanctimonious, truth-challenged screeds against progressives? Why do these papers so consistently sabotage human progress?
If you’re looking for evidence of the Chron’s political agenda, just read Marinucci’s two front-page stories in the last two days, both of which made the exact same accusation against gubernatorial hopeful Phil Angelides: The stories said rich developer Angelo Tsakopoulos was trying to buy the election, and a future governor’s allegiance, with about $9 million worth of independent expenditures favoring Angelides.
Such editorial overkill is clearly designed to hurt Angelides and help his Chronicle-endorsed challenger, Steve Westly. Why else would both articles bury or ignore key facts in the story?
Tsakopoulos isn’t the political neophyte Marinucci pretends he is. He’s actually been one the top regular contributors to Democrats for almost a generation (Bill Clinton used to stay with Tsakopoulos during California visits throughout his presidency); he’s also a close friend and mentor to Angelides, not simply someone trying to buy his way into a position of influence. Tsakopoulos already had Angelides’ ear; he didn’t need to spend a dime to get it.
I’m certainly not arguing that sizable independent expenditures aren’t notable, worrisome, or newsworthy. In fact, the Guardian this week reported that Sup. Fiona Ma has benefited from more than $750,000 in IEs on her behalf, most of that from the same sorts of corporate power brokers that the Chronicle regularly supports.
So why didn’t this story make the Chronicle’s front page even once, let alone on two consecutive days the week before the election? After all, the money spent on Ma’s behalf was a far higher percentage of the campaign spending in that race – and will likely have a bigger impact – than what Tsakopoulos spent on the governor’s race.
And it came from sources who really do have an interest in influencing Ma – the tobacco and liquor lobbies, gaming interests, developers, and her old boss, John Burton, who wants to retain his power broker status.
Maybe one reason is the fact that the Chronicle endorsed Ma and has been running the very attack ads that these IEs paid for (which, not so coincidentally, run right next to the web versions of Marinucci’s stories).
Another reason could be Marinucci’s barely concealed schoolgirl crush on Gov. Arnold Schwarzenegger, who her articles have described in terms that are flattering and deceptive (see “Couple in the news," www.sfbg.com/40/17/news_shorts.html). It happens again and again. Just pop over to sfgate.com, do a search using “Marinucci and Schwarzenegger” and you’ll see what I mean.
I sent an e-mail to Marinucci and five Chronicle editors raising these points, and here was Marinucci’s response: “As a longtime reader of the San Francisco Bay Guardian, I’m going to refer you to a wonderful motto which I know your publisher, Bruce Brugmann, and many of the people on your staff understand. It’s on your paper’s masthead: "It is a newspaper’s duty to print the news and raise hell.”
    “It’s absolutely your right not to like our stories. Sometimes, the candidates — Republicans and Democrats — don’t like them either.  There’s no hidden agenda or anything else in play, another than another old newspaper motto that Brugmann also understands well: that we do the job "without fear or favor, regardless of party, sect, or interest involved."
I responded that her quotes didn’t seem to answer my questions, particularly because the second one seems to directly contradict her approach to political coverage, in which she seems to reserve her attacks for the most liberal candidate in any race. But she didn’t respond to my follow-up questions. 
We at the Guardian have our own bias – a progressive bias – and we spend more column-inches helping our friends and hurting our enemies than the other way around. It’s something we’ve always been honest about, unlike the Chronicle, which pretends to the high standard of “objectivity.” We strive for fairness to all sides and don’t apologize for advocating the broad public interest.
But we have no self-interest in our approach. We don’t like Ma’s opponent, Janet Reilly, because she’s going to defend our corporate interests in Sacramento. We like her simply because she’s far smarter and more progressive than Ma. And we don’t like the IEs attacks on her because they attempt to fool voters into believing just the opposite – deceptively misrepresenting where these two candidates fall on the political spectrum — something all newspapers should actively oppose.
Yet neither Ma, Marinucci, Garcia, nor any of the wealthy interests they represent seem to have much regard for the truth, at least around election time. I suppose that’s their prerogative, and perhaps just the nature of the beast. But San Franciscans deserve better, and they should be offended that they aren’t getting it from their daily newspapers.    
 

Ficks’s picks (and one no-pick) at Cannes

1. John Cameron Mitchell’s midnight premiere of his sensitively X-rated Shortbus not only roused the Palais’s audience to a 15-minute standing ovation (a legendary feat); it brought out some of the deepest tears I have shed in my short life. Warning: The MPAA (which we now finally understand, due to Kirby Dick’s revolutionary exposé This Film Is Not Yet Rated) won’t know where to start with this sucker. It’s much more than the graphic sex; it’s the graphic honesty.

2. William Friedkin’s schizo-thriller Bug built to such a creepy and intense climax that dozens of viewers were screaming at the top of their lungs, freaking me out almost as much as Lynne Collins and Ashley Judd’s performances. Friedkin graciously accepted the comparison that someone made to the last 30 minutes of his 1971 classic The Exorcist. Yep, it’s that fucked up.

3. Fans of the transcendental cinema movement from South America (La Ciénaga, La Niña Santa, Los Muertos) have another reason to live with Paz Encina’s heavenly Hamaca Paraguaya. The film watches a couple as they softly pass the days, waiting for their son to come home from a war. Dozens walked out; the rest of us enjoyed quite the quiet masterpiece.

4. Nobody even those of you who skipped his subversively brilliant remake of The Bad News Bears should miss Richard Linklater’s brave adaptation of Eric Schlosser’s Fast Food Nation. It tackles the current circle of corporate consumption, from hiring illegal immigrants to unsafe working conditions to the processing of feces in your most favorite hamburgers (which ultimately get served to you by the apathetic future of America). This movie is required viewing for every single teenager as well as all y’all who think you know how bad things really are.

5. Donnie Darko writer-director Richard Kelly’s second film, Southland Tales, was the biggest disappointment of the festival (if not the decade!). This 2 hour and 40 minute disaster does almost everything wrong: Its pathetic politics are high schoolcoffee shop theories; its convoluted story lines are utterly irrelevant; and lastly (and most surprisingly), the characters come off as hollow, one-note ideas that either get one interesting sequence (Justin Timberlake singing a Killers cover) or many useless scenes (featuring Janeane Garofalo, Miranda Richardson, and Wallace Shawn, to name a few). Ironically including many exSaturday Night Live stars, this extravaganza comes off as an out-of-breath bad TV show. Ouch. (Jesse Hawthorne Ficks)

Look: The Transbay Terminal project is all fucked up, about as bad as anything in city government could be, and a lot of people are at fault.

Supervisor Chris Daly isn’t one of them.

I say this because the No on Proposition C campaign has become little more than a personal attack on Daly, who authored the measure that would change the makeup of the Transbay Terminal authority. I’m not voting for Prop. C I don’t think it’s going to solve the problem but I do think Daly makes a very good case that change is needed, and I think he’s making a good faith effort to fix it. I mean, at least he’s doing something.

So why are there flyers and posters all around town attacking Daly and saying he is trying to “hold up” the Transbay Terminal project? Mark Mosher, who is running the No on D campaign, argues that Daly “should be held accountable” for his proposal, but that’s horseshit. The real reason, Mosher agrees, is that attacking Chris Daly wins votes in many parts of town.

It’s a sleazy way to run a campaign, and the mayor who is really behind all of this nonsense needs to put an end to it, now.

Onward: much, much ado at the Coalition of San Francisco Neighborhoods meeting May 16. The agenda for a group that has too often been under the sway of Joe O’Donoughue included a proposal to rescind the coalition’s endorsement of Prop. D, the badly flawed Laguna Honda measure.

Joe and his ally, former CSFN president Barbara Meskunas, had pushed for (and won) an early endorsement of the measure, which would use zoning rules to ban certain types of patients from the hospital. Somehow, though, the Yes on D presentation wasn’t entirely complete: Most CSFN members who initially voted to back the plan didn’t realize that it had potentially much more sweeping impacts, and could legalize private development on a lot of other city property.

As news about what Prop. D really meant began to get out, some coalition members demanded a new vote and after a month’s parliamentary delay, they got one.

The debate, I’m told, was lively: At one point, Tony Hall, whom the mayor appointed to head the Treasure Island Development Authority, accused Debra Walker, a longtime progressive, of being a "stooge for the mayor." Ultimately, though, the vote to rescind the endorsement won, 238, with Hall, Meskunas, and Newsom-appointed planning commissioner Michael Antonini in the minority.

Shortly afterward, the members voted on new officers, and a slate of candidates led by Meskunas was roundly defeated. At which point Meskunas stormed out of the room, later resigning from the organization.

"This was a battle for the soul of the coalition," Tony Kelly of the Potrero Boosters told me. "It’s been brewing for a while."

Yeah, it’s just one more San Francisco political group and one more internal battle, but it might mean a lot more. First of all, it shows that Hall and Antonini both, remember, Newsom appointees are coming on strong against the mayor, fueling the theory I keep hearing that Hall will challenge Newsom from the right in 2007 (and try to get his friend Matt Gonzalez, who also supports Prop. D, to mount a challenge from the left).

Gonzalez told me he hadn’t heard anything about that plan yet (and he found it quite odd), but (of course) he’s not ruling out another mayoral campaign. SFBG

Shooting at the OCC

When the head of the city’s police union, Gary Delagnes, appeared before the San Francisco Police Commission May 10, he told a story based on his recent lunch with Boston’s former top cop, Kathleen O’Toole.

"We talked about the similarities between San Francisco and Boston and the similar problems that we have," Delagnes recounted. "Commissioner O’Toole said to me, ‘Gary, you have one problem, hopefully, I won’t ever have to worry about, and that’s the OCC.’”

She was referring to San Francisco’s Office of Citizen Complaints, the watchdog agency that accepts and investigates allegations of police misconduct. Delagnes and others in the 2,200-member San Francisco Police Officers Association rarely conceal their disdain for the OCC and have regularly attacked it in the past.

But OCC officials say the cop union will always have it in for them, simply because they’re good at what they do: holding officers accountable for their actions.

No news outlet in town started the year without at least one major story noting the slow pace of homicide investigations and the city’s persistently high murder rate. A series of stories published by the San Francisco Chronicle in February that were critical of the police department’s use of force against civilians led to citywide calls for reform. And a satirical video made by an officer late last year that appeared, at the very least, latently racist and homophobic drew the wrath of the mayor.

Despite the department’s troubles, however, Delagnes seems interested in attacking the OCC for reminding residents that they have the right to report bad police behavior.

In a letter to the commission written May 10, Delagnes claimed the agency had "apparently been soliciting certain members of the community to file complaints against San Francisco police officers." Setting his sights on the OCC’s lead prosecutor, Susan Leff, he fumed that her "outreach" had called into question her ability to conduct an objective analysis of any personnel matter involving San Francisco police officers."

"We find such behavior on the part of the attorney responsible for prosecuting police officers in this city reprehensible if not downright scandalous," Delagnes wrote.

Attached to the letter was an e-mail from Leff that Delagnes claimed proves his charges. The message, sent out late last September, was a response from Leff to a community member inquiring about what could be done to address an unidentified incident involving alleged infractions by a group of officers.

"I am very concerned about taking a complaint as soon as possible, so that the witness’ memories of what they saw do not begin to fade," Leff wrote in the e-mail. "You or anyone else could file an anonymous complaint so we could start investigating."

There doesn’t appear to be anything illegal about this, and OCC Director Kevin Allen argued as much in a letter to the commission the very next day. But the POA has never liked anonymous complaints, and in his letter, Delagnes demanded that Leff be placed on leave until the city attorney and police commission conduct a full investigation.

"I don’t think there’s going to be an investigation," Allen later told the Guardian. "I don’t think the city attorney works for Mr. Delagnes." Asked whether Leff would be placed on leave, Allen responded, "Please. This agency supports Susan Leff, and she will continue as our litigator."

Allen stated in his response letter to the commission that Leff’s effectiveness at doing what the OCC was formed to do had made her a target "for those POA members who believe that no officer no matter how egregious his or her misconduct should be disciplined."

"The POA has long engaged in these thug-like tactics to undermine and intimidate the OCC," Allen’s letter reads. "I have personally been subject to their attacks, as have members of the Police Commission. I will not tolerate these attacks on OCC employees."

The commission essentially agreed, because a week later it appeared to reject the complaint and chided the POA for leveling a personal charge at Leff and the OCC in the first place. The City Attorney’s Office told us that so far, no city officials have requested an investigation.

With police officers experiencing so much uncomfortable scrutiny right now, the timing of Delagnes’s letter looks terribly convenient.

Partly as a response to the Chronicle stories and a resulting vow to "run roughshod" over the department made by Mayor Newsom, the police department recently began drafting a new Early Intervention System designed to identify disturbing patterns of police misconduct among problem officers. Early last month, the OCC noted "several glaring weaknesses" in the department’s current EIS draft.

Publicly, the POA insists the group is not opposed to the idea of civilian oversight. But comparing San Francisco’s cop-watch agency to other such offices around the country, POA spokesman Steve Johnson told us in a phone interview, "I know no other agency that has as much power as they do."

"There’s a real problem with the process itself," he complained.

Further, just as Delagnes submitted his letter to the commission, the POA was buoyed by a San Francisco judge’s ruling, handed down in early May, in a lawsuit filed by four police officers against the OCC. The OCC had charged the four officers with wrongdoing after a suspect was shot and killed during a May 2004 car chase. The court tossed the charges against the officers, citing an administrative mistake on the part of the OCC. But the judge made clear that the OCC could still file new charges against the four cops.

In the wake of the decision, Johnson told us that the POA was looking to discuss changes to OCC procedure during an upcoming law enforcement summit organized by former police chief Tony Ribera and former mayor Frank Jordan scheduled to be held at the University of San Francisco.

Formed as the result of a ballot measure passed by voters in 1983, the OCC is one of the few citizen-review entities in the United States with the power to subpoena officers. But otherwise, it simply investigates complaints and determines whether to sustain them. Only the chief of police and the police commission can file actual charges or exact disciplinary measures against officers.

Anonymous complaints, which the POA has long decried, cannot be sustained without additional evidence. And under the state’s Peace Officers Bill of Rights, details of complaints and investigations are not publicly accessible unless they make it all the way to the police commission. Between January and September of last year, 55 cases were sustained, but the OCC has hundreds of pending cases.

Up to three years before the Chron stories, the Northern California Chapter of the ACLU, the City Controller’s Office, the Guardian, and the OCC had called on the police department to implement new best practices policies instituted in other cities. But the department reacted slowly, at least until victims of police brutality began appearing in broad snapshots across the pages of the city’s largest daily newspaper for several days in a row.

OCC director Allen maintains that Delagnes and the POA were too eager to protest the agency.

"It concerns me that the POA didn’t act in a diligent manner to find all the facts," he told us. "They acted a little impulsively." SFBG

I was sitting peacefully at home, watching the final episode of The West Wing, which my partner describes as "liberal porn," when Steve Westly drew first blood in the governor’s race.

We all knew there’d be some negative ads before this was over, and frankly, all the hand-wringing about the evil of negative campaigning has never really appealed to me: Politicians have been launching vicious, often slanderous attacks on their opponents since the dawn of democracy. But this one made me furious.

The simple story is that Westly borrowing a chapter from the Book of Rove is assailing Phil Angelides for wanting to tax the rich. And he’s doing it in the most misleading, unprincipled, and utterly disgraceful way.

The ad features what seems like a crushing list of new taxes that Angelides wants to impose $10 billion worth, Westly’s hit squad claims. Then it winds up with a smarmy tagline: "With high gas prices, housing and health care costs, can working families afford Phil Angelides’s tax plan?"

Of course, Westly had pledged some time ago not to be the first candidate to attack the other by name, but what the hell: The election’s coming up, the race seems to be narrowing, and this guy will do whatever’s necessary to win.

But more than that, with this ad Westly is promoting the exact mentality that has damaged public education, health care, environmental protection, infrastructure needs, and so much else of what used to be the California dream. Republicans love to hit Democrats on taxes, and we’ll see plenty of that in the fall, no matter who’s the nominee. And for Westly to start the "no new taxes" cry just leaves the Democrats politically crippled.

For the record, Angelides is right: The state needs more tax revenue. And under his proposal, most of it would come not from "working families" who are worried about their gas bills but from people like, well, Steve Westly and Phil Angelides millionaires. His proposed income tax increase only affects households with more than $500,000 in income. Sorry: You’re in that range, you can afford it.

So Mr. Westly: Stop with the antitax lies. This shit makes me sick.

On to the good news.

I get the feeling, from over here in San Francisco, that there’s a real change afoot in East Bay politics. For the past few years, a not-so-loose cadre made up of state senator Don Perata, Mayor Jerry Brown, and Councilmember Ignacio De La Fuente has been consolidating power in Oakland, calling the political shots and giving developers a blank check. Two of the three have real, ahem, ethical issues, and one’s itching to leave town for Sacramento, but so far, nobody’s been able to truly challenge them.

Until Ron Dellums.

Now, I know that Dellums has been out of Oakland for years, that he’s a DC lobbyist, and I’ve heard the rap that he’s long on rhetoric and short on urban policy ideas. But we met him last week, and I can tell you that, at 71, he’s still one of the most energetic and inspirational speakers around, and if he’s elected mayor, he will, by force of personality and national stature, instantly become a center of power that’s distinct from (and will often be in opposition to) the Perata<\d>De La Fuente bloc. IPI Calls on the European Union to raise the issue of press freedom in Latin America and the Caribbean during the EU-LAC Summit in Vienna, Austria

On the occasion of the European Union Latin America and Caribbean (EU-LAC) Summit in Vienna, Austria, the International Press Institute (IPI), the global network of editors, media executives and leading journalists, calls on the European Union (EU) to raise the issue of press freedom and freedom of expression.

In the Americas, at least 11 journalists were killed because of their work in 2005. Three journalists were murdered in Haiti, and two each in Brazil, Colombia and Mexico. Journalists were also killed in Ecuador and Nicaragua.

Throughout the year, investigative journalists in Latin America continued to receive death threats, or were physically attacked by corrupt officials, drug traffickers and other criminals intent on preventing the media from exposing their activities. Several journalists were forced to flee into exile. In addition, journalists had to contend with a barrage of litigation, including criminal defamation lawsuits and excessive punitive damage awards in civil suits.

Media outlets criticised government restrictions on access to public information, often the result of anti-terrorism legislation introduced in response to the terrorist attacks of 11 September 2001. The use of official advertising to punish or reward publications and broadcasters was also condemned as a threat to press freedom. In some countries, the excessive use of force against journalists by the police and army was a cause for concern.

With 23 journalists imprisoned at the end of 2005, Fidel Castro’s Cuba was the world’s second biggest jailer of journalists after China. Those independent journalists not already arrested in the March 2003 government crackdown on political dissidents were systematically monitored, harassed or detained by the state security forces.

Mexico saw an increase in the number of violent attacks against reporters, especially those investigating drug trafficking and official corruption in the northern states bordering the U.S.

The administration of President Hugo Ch?�vez tightened its grip on the press in Venezuela, as the Social Responsibility Law for Radio and Television and amendments to the penal code, expanding the categories of government officials protected by insult provisions, came into effect in 2005.

In the Caribbean, the introduction of restrictive new media legislation, the continued use of civil and criminal defamation laws, and instances of government interference in state-owned media, all encouraged the tendency to self-censor.

Speaking on the press freedom situation in the region, Michael Kudlak, IPI’s press freedom advisor for the Americas and the Caribbean, said, “Increasingly, authorities are attempting to use defamation laws, broadcasting regulations, and other legal measures to stifle critical coverage, posing a serious threat to freedom of opinion and expression in the Caribbean.”

IPI Director Johann Fritz added, “IPI calls on the Austrian Presidency of the European Union and heads of EU member states to address freedom of expression and media freedom in Latin America and the Caribbean during the EU-LAC summit. At a time when journalists suffer harassment and must resort to self-censorship, there is a real need for the EU’s dialogue with many Latin American countries to be informed by greater discussion about press freedom and freedom of expression.”

“IPI urges the governments of the region to uphold everyone’s right to freedom of opinion and expression, including the right ‘to seek, receive and impart information and ideas through any media and regardless of frontiers,’ as outlined in Article 19 of the Universal Declaration of Human Rights,” Fritz said.

IPI, the global network of editors, media executives and leading journalists, is dedicated to the furtherance and safeguarding of press freedom, the protection of freedom of opinion and expression, the promotion of the free flow of news and information, and the improvement of the practices of journalism.

A few questions for the publishers

OPINION The MediaNews Group, which proposes to buy the San Jose Mercury News, the Contra Costa Times, the Monterey Herald, and 30 Bay Area weekly newspapers, is paying a 20 percent premium over the price McClatchy paid Knight-Ridder for those same publications less than two months ago. Antitrust regulators in the US Justice Department, who must decide whether to go to court to try to block the transaction, will want to know why.

There are two possible explanations. One is that MediaNews, which already owns or controls eight daily and three weekly newspapers in the Bay Area, thinks the deal will yield economies of scale, allowing it to operate its newly acquired properties more efficiently than Knight-Ridder was able to. Another explanation is that MediaNews’s dominance of a restructured market will enable it to raise advertising rates.

From the standpoint of antitrust, the first reason is completely benign. Antitrust regulators will be very concerned, however, if they suspect the second explanation: that MediaNews paid a premium because its competitive position in the Bay Area newspaper market where its circulation will rise from approximately 290,000 predeal to more than 800,000 postdeal will permit it to raise rates.

MediaNews’s share of the Bay Area daily newspaper market will be somewhere north of 65 percent if the McClatchy sale goes through as planned. While that is a high degree of market concentration and almost certainly would have drawn a challenge from the Justice Department 20 years ago it is likely to be seen today as inconclusive.

Why? Because these newspapers compete not only with each other but also with Craigslist, eBay, Yahoo!, Google, and numerous other Internet-based businesses (not to mention television and radio) offering help-wanted ads and real estate and auto listings, as well as display advertising.

But another aspect of the McClatchy-MediaNews deal is not so easily dismissed. I’m referring to the role of Hearst, owner of the San Francisco Chronicle, which will be MediaNews’s primary competitor in the Bay Area.

As part of the deal, Hearst will also become a MediaNews investor and partner. The questions the regulators will ask are these: Why Hearst of all possible investors? If Hearst’s only function is to be a source of investment capital for a deal between McClatchy and MediaNews, why not use other investors whose participation would raise no competitive issues at all? Why use the one company that has the resources and incentive to object to the deal and whose participation creates at least the risk of a lessening of competition?

Whatever the answer, the public is entitled to have the Justice Department or Federal Trade Commission hear it and make its own judgment. Although filings with Justice in such "pre-merger reviews" are generally confidential, let’s hope that McClatchy, MediaNews, and Hearst, which are all in the business of making information public, will elect to tell their readers what they’re telling government regulators. Members of the newly formed San Francisco Outdoor Events Coalition gathered on the evening of May 3. It had been a long, discouraging day, and the mood was somber.

Robbie Kowal of the North Beach Jazz Festival apologized for not having an agenda ready. "Frankly, I was too busy fighting for the future of my festival at City Hall today," he joked, but nobody really laughed.

Earlier that day, the Recreation and Park Commission Operations Committee voted to deny the jazz festival the right to sell beer and wine inside Washington Square Park. The decision followed a precedent the committee first set last month regarding the larger North Beach Festival (see "Last Call?" 5/3/06).

Alcohol sales provide the bulk of the funding for the free music, but commission president Gloria Bonilla suggested they explore other money sources and sponsorship.

"The idea that there can’t be successful events in the city without alcohol, I can’t buy into," Bonilla said at the meeting.

Unfortunately, the jazz festival isn’t solvent enough for such a firm policy and can’t afford to lose the source of 75 percent of its funding less than three months before the event.

"She wants us to pass the hat," Kowal said at the coalition meeting. "We did that last year and we got 78 bucks."

North Beach Jazz Festival is a big generator of fun and revenue for the city, but its organizers say they don’t make any money off the deal.

"It’s a labor of love," said Kowal, who is considering canceling the festival despite the signed contracts and purchased plane tickets for performers.

Twenty-seven individuals came to the hearing to speak in support of the festival, including Board of Supervisors president Aaron Peskin, who represents North Beach and has been critical of how the North Beach Festival beer gardens prevent underage people from entering the park.

The three-member committee encouraged the Jazz Festival promoters to pursue other options, like beer gardens on barricaded streets, but took a hard line on booze in the park.

"What I’m interested in is a consistent and fair application of the policy. We’ve said no alcohol. While I appreciate having Supervisor Peskin come speak to us today, I think we need to be consistent in this policy," Commissioner Meagan Levitan said at the hearing.

Rec and Park general manager Yomi Agunbiade and director of operations Dennis Kern have said "a growing public concern" caused them to recommend against the sale of alcohol for the two North Beach festivals.

"Rec and Park has a new general manager and a new director of operations who are very experienced but come here from other cities," Kowal said. "There’s some missing institutional knowledge. We are not Walnut Creek, we are not Chicago, we are not DC. We’re San Francisco, and we have our own unique culture."

On May 8, a select group from the coalition met with senior staff from the mayor’s office to express its growing concern over increased fees and decreased city services and to discuss the grave implications of Rec and Park’s recent decisions for other outdoor festivals in the city. After the meeting Kowal was optimistic and said the mayor and supervisors expressed support for the festivals, but he acknowledged, "We don’t live in a city where the mayor can say, ‘This is how it’s going to be.’ It’s going to come down to the commission again. If people want to see this festival survive, they have to come to City Hall on May 30."

That’s the date that the full Rec and Park Commission will decide whether to overrule the Operations Committee and allow booze back into the park during the two festivals. SFBG

WHEREAS, On March 13, 2006 the McClatchy Company agreed to a deal to purchase Knight Ridder Inc., the second-largest newspaper company in the United States; and
WHEREAS, The McClatchy Company has announced plans to sell twelve of the Knight Ridder newspapers, resulting in the MediaNews Group gaining ownership or control of three major Bay Area newspapers: the San Jose Mercury News, the Contra Costa Times, and the Monterey County Herald, and twenty-nine other Bay Area community newspapers; and,
WHEREAS, The thirty-two newspapers that MediaNews Group would gain control of have a total daily circulation of 524,210; and,
WHEREAS, MediaNews Group would gain ownership or control over every major daily in the San Francisco Bay Area except for the San Francisco Chronicle; and,
WHEREAS, The owner of the San Francisco Chronicle-the Hearst Cooperation-is partnering with MediaNews Group in this acquisition; and,
WHEREAS, The acquisition of the Knight Ridder newspapers was apparently not opened to all qualified bidders; and,
WHEREAS, Such a consolidation of media ownership could deprive Bay Area readers of the quality and depth of news coverage that more varied ownership offers; and,
WHEREAS, The MediaNews Group’s proposed acquisitions could also hurt advertisers by a diminution of print and Internet media outlets and a likely increase in advertising rates that a single owner in the market could demand; now, therefore, be it
RESOLved, That the Board of Supervisors of the City and County of San Francisco urges the United States Attorney General and the California Attorney General to carefully consider the antitrust implications of the proposed acquisition of Knight Ridder Inc. by the McClatchy Company, and the McClatchy Company’s proposed resale of thirty-two Knight Ridder newspapers to the MediaNews Group.

How to fight Singleton’s monopoly

EDITORIAL Six members of Congress wrote to the Bush administration last week urging a full Justice Department review of the pending deal that will give one company the Denver-based MediaNews Group control over virtually every daily newspaper in the Bay Area. The letter is a signal that federal regulators may be unable to simply duck this merger but it will take a lot more pressure to block it.

As we reported last week, MediaNews, run by Dean Singleton, is planning to take over the San Jose Mercury News, the Contra Costa Times, the Monterey Herald, and the St. Paul Pioneer Press. That would mean every big central Bay Area daily except the San Francisco Chronicle would be owned by one company. And to make it worse, Hearst the New York Citybased owner of the Chron has signed on with MediaNews as part of the deal: Hearst will buy the Monterey and St. Paul papers, then immediately trade them to MediaNews in exchange for stock in some other MediaNews ventures.

The implications are staggering. The deal sets the scene for an unprecedented level of local media consolidation and could lead to a scenario in which all the business, advertising, and even editorial functions of almost every Bay Area daily would be run out of one central office.

Reps. Zoe Lofgren, George Miller, Anna Eshoo, Ellen Tauscher, Barbara Lee, and Mike Honda wrote: "We are concerned that this transfer could diminish the quality and depth of news coverage in a Bay Area of more than 9 million people." That’s a good concern: Singleton, known as "lean Dean," is known for ruthless cost-cutting and is likely to reduce news staffing at all of the papers to save money. He’s also likely to take advantage of a virtual monopoly on daily print to jack up advertising rates, hurting businesses and consumers.

The letter quotes Reps. Mark Kennedy and Jim Oberstar of Minnesota as noting: "A monopoly in the newspaper industry is certainly no less dangerous, and is perhaps more so, than in any other American industry." Which is exactly the point: When control of something as essential as civic information is in the hands of too few people, it’s a direct threat to democracy.

It’s clear that the Internet has made daily newspapers less powerful and less essential. But in the Bay Area (and in most of the country) there’s simply no Web alternative that can do the work of a daily paper. Real watchdog journalism requires a staff reporters to go to meetings, to challenge politicians, to stay on top of City Hall and so far, nobody’s found a financial model that allows that to happen purely online.

So the threat of one single entity controlling news and information to such a huge extent ought to be a major issue across the state, particularly in the area where MediaNews has most of its holdings. We’re glad that some members of Congress are pressuring the White House, but we don’t really expect Bush’s Justice Department to mount a full-court press on this one. That effort is going to have to come from the state and from local government.

We’ve asked both Democratic candidates for governor about the issue, and both at least showed some interest. Phil Angelides didn’t seem to know much about it until we clued him in, but he said he was "concerned." He needs to do better: A strong statement opposing the deal would be a good start. Steve Westly is friendly with the Newspaper Guild folks in San Jose and has supported their efforts, but he has also stopped short of a blanket statement that the merger must be derailed. And neither the current attorney general, Bill Lockyer, nor either of the major contenders for the job (Jerry Brown and Rocky Delgadillo) has said much of anything.

However, state senator Carole Migden expressed some interest in holding hearings in Sacramento, and that ought to happen immediately. Lockyer should be asked to explain what he’s doing to stop the deal and the publishers should be asked to reveal the details of the merger and their future plans (see "A Few Questions for the Publishers," page 7).

Every city in the Bay Area should take this on too, starting with the San Francisco Board of Supervisors, which should hold hearings and pass a resolution demanding that Lockyer block the deal.

Only serious grassroots opposition can prevent this monster of a media monopoly. There’s no time to waste. SFBG

Single town?

Like Clear Channel radio stations, many smaller papers would have little or no staff, nobody to answer the phone, nobody to take local tips and cover local news … they would be nothing but shells of once-thriving community newspapers.

This map, prepared by the San Jose Newspaper Guild, shows all of the newspapers that will soon be owned by Dean Singleton’s MediaNews Group. MediaNews started out with 11 papers, and the addition of 33 Knight-Ridder papers will give the Denver-based outfit a total of 44 daily and community papers in the Bay Area.

Most of the daily newspaper coverage of the deal (including the coverage by Knight-Ridder and MediaNews papers) has focused on the four biggest papers involved and ignored the smaller papers altogether — a sign, perhaps, that neither chain cares that much about community publications.

Stop Singleton’s media grab!

EDITORIAL At first glance, it looks like one of the oddest deals in recent newspaper history: McClatchy, the Sacramento-based newspaper chain, buys the much bigger Knight-Ridder chain, then sells two of the Knight-Ridder papers to MediaNews Group, run by Dean Singleton out of Denver, and two to the New York Citybased Hearst Corp., which owns the San Francisco Chronicle. Then Hearst immediately sells its two papers to Singleton’s shop, in exchange for an equity share in MediaNews operations outside of the Bay Area.

The upshot: MediaNews will take over the San Jose Mercury News and the Contra Costa Times, along with some 33 small-market dailies and weeklies, which, combined with the 11 Bay Area papers the chain already owns, will give Singleton control of every major daily newspaper in the Bay Area except the Chronicle.

It creates the potential for a newspaper monopoly of stunning proportions and threatens the quality of journalism in one of the most populous, educated, and liberal regions in the nation. Singleton, known as "lean Dean" for his cost-cutting moves, is likely to slash staffing at papers like the Times and the Merc, consolidate news gathering, and offer readers less local news.

In fact, in its most recent annual report, filed with the Securities and Exchange Commission, MediaNews outlined its strategy for profitability. "One of our key acquisition strategies is to acquire newspapers in markets contiguous to our own," the report states. This so-called clustering strategy allows the company to consolidate advertising and business functions as well as news gathering. "We seek to increase operating cash flows at acquired newspapers by reducing labor costs," the report notes.

In other words, a smaller number of reporters will be doing fewer stories, which will run in more papers. This, Luther Jackson, executive officer of the San Jose Newspaper Guild, argues, "means cookie-cutter coverage and fewer voices contributing to important public policy debates."

There are deeper concerns with this deal including the possibility that Hearst and Singleton could be forming an unholy alliance that would nearly wipe out daily competition in the Bay Area.

The whole mess has its roots in the decision by the Knight-Ridder board several months ago to put the company up for sale. It was the kind of decision that demonstrates the problems with treating newspapers like baseball cards, to trade on the open market: Knight-Ridder was quite profitable, ran some of the better newspapers in the nation, and had a reputation (by chain standards, anyway) of being willing to spend money on the editorial product. But the stock price wasn’t quite high enough, and a few big shareholders (who weren’t satisfied with 20 percent profits) were complaining, so the entire company went on the block.

McClatchy, a well-managed company that has the Sacramento Bee as its flagship, wanted some of the Knight-Ridder papers but only the ones in fast-growing markets. So after submitting a winning bid, the McClatchy folks starting looking for ways to dump the San Jose Mercury News, the Contra Costa Times, the Monterey Herald, the St. Paul Pioneer-Dispatch, and some 20 smaller community papers in the Bay Area.

But why, exactly, is Hearst getting involved? Well, Peter Scheer, a former antitrust lawyer who runs the California First Amendment Coalition, has some theories. The first possible reason? Hearst has plenty of cash on hand, and the deal would allow MediaNews to avoid having to seek as much financing from bankers.

More likely: Hearst through the Chronicle would have been Singleton’s only local competitor, and is the only significant political player in California that could have pressured regulators to oppose the deal. The arrangement, Scheer says, turns Hearst from a potential foe into a partner. Already the two companies have announced they may seek to share distribution systems. And there may be other plans in the works.

In fact, one of the most interesting ideas about the deal comes from a former Chronicle assistant managing editor, Alan Mutter, who writes a blog called Reflections of a Newsosaur (newsosaur.blogspot.com). Mutter suggests that the deal might lead to the end of real newspaper competition in the Bay Area, for once and for all. "Hearst," he speculates, "hopes at some point to work with MediaNews to extricate itself from the costly problem posed by the San Francisco Chronicle, which is widely believed to be losing about $1 million per week."

The idea: Down the road, Hearst merges the Chron with MediaNews or, if the Justice Department won’t allow that, the two companies enter into a joint operating agreement. A JOA works like this: The two companies share all printing, business, sales, and distribution operations, run two theoretically separate newsrooms, and at the end of the day split the profits. The Chron and the Examiner were run for years under a JOA, and it was terrible for readers: With no economic incentive to compete, both papers stagnated. But it can be the equivalent of a license to print money.

"Unlike some publishers who shun JOA relationships," Mutter notes, "Dean Singleton has embraced them and seems to be making them work in places like Denver and Detroit. Is the San Francisco Chronicle next on his list?"

Imagine what a near-complete monopoly of Bay Area dailies in the hands of a notorious cost-cutter would mean. For starters, we can count on more standardized, conservative politics (at least the Knight-Ridder papers opposed the war). Perhaps all reporting and editing would be consolidated into one newsroom, in San Francisco or San Jose. Like Clear Channel radio stations, many smaller papers might wind up with little or no staff, nobody to answer the phone, nobody to take local tips and cover local news … they’d be nothing but shells of once-thriving community newspapers. They would have abandoned the crucial local-watchdog role of a daily newspaper (and made life more difficult for the few remaining independents).

The fact that this is a possible, even likely, scenario is alarming. In short order, one company could control every major daily in the Bay Area (except the Examiner and the Santa Rosa Press-Democrat) fixing prices, sharing markets, pooling profits, and keeping ad rates artificially high and the quality of journalism abysmally low.

Have there been discussions around this? What is Hearst’s real interest here, and how does it jibe with Singleton’s dream of a massive regional "cluster"? Until we know the answers, the MediaNews-McClatchy deal should never go forward.

It’s almost too much to ask that the Bush administration, which loves big-business mergers, give it a thorough review. But the California attorney general has grounds to challenge it too.

AG Bill Lockyer completely ducked on the deal that merged the two largest chains in the alternative press, Village Voice Media and New Times. He can’t be allowed to duck this one: There must be a detailed, public investigation, and the newspaper chains must come clean and release the details of the deal. The two leading Democratic candidates for attorney general, Jerry Brown and Rocky Delgadillo, need to make this a top issue in the campaign. It should be an issue in the governor’s race, and every city and town that’s affected, including San Francisco, should pass a resolution against the merger. SFBG

One could be forgiven for staring. Oakland’s lower Telegraph Avenue on a wet, cold, windy Friday night is not a location renowned for its street parties, particularly those involving dozens of young, white hipsters happily mingling with an equal number of young African Americans, both watching an impromptu rap show.

But a street party is precisely what was happening outside the Rock Paper Scissors (RPS) Gallery, at Telegraph and 23rd Street, that night. Welcome to Art Murmur, Oakland’s very own art walk on the first Friday of every month. What started in January as an eight-gallery venture has, in a mere four months, blossomed. A dozen Oakland galleries now participate, exhibiting everything from installations featuring massively oversized pill bottles and pillboxes to traditional oil portraitures and, in the case of the Boontling Gallery, unnerving little sculptures that co-owner Mike Simpson described as "whimsical takes on decapitation."

"We want to improve the art scene in the East Bay so that people will call Oakland an artistic force to be reckoned with," the lanky Simpson told the Guardian. "Oakland has a lot of potential, and I have a lot of pride in the city…. A lot of artists who show in San Francisco are from Oakland. Why not represent where they are from?"

But jump-starting an artist-driven revival of lower Telegraph also has its potential hazards, prime among them gentrification. As San Franciscans know all too well, such revitalization carries the danger that the community will be made safe for real estate agents, developers, and urban professionals who quickly eliminate less desirable residents, i.e., the folks who were there first and the new artists’ community.

When asked about the issue, Sydney Silverstein of the RPS Collective knowingly said, "Oh, you mean artists laying the groundwork for gentrification?"

Setting the gentrification question aside for a moment, something new and very exciting is happening along Telegraph Avenue, come rain or shine.

"We want to get people to buy art that have never bought art before," nattily attired Art Murmur cofounder Theo Auer said as he sipped free wine. It is not just the young and trendy who show up more than one gray-haired art aficionado was spotted making purchases at Boontling.

How did it all start? According to Auer, the midwife was beer. "It was after a show, and we asked each other, ‘Why doesn’t Oakland have an art walk?’ ‘How hard can it be?’" The result was a meeting last year at which RPS, Mama Buzz Café, Ego Park, 21 Grand, 33 Grand, Auto Gallery, Boontling, and the Front Gallery all chipped in money for logistics, postcards, an www.oaklandartmurmur.com Web site, and a newspaper ad.

"It’s a tight community," said Tracy Timmins, the pale-blue-eyed and enthusiastic co-owner of Auto Gallery. "We are all very supportive of each other." And that support also comes from her landlord, who is only too happy to have a group of impoverished students who want to improve the neighborhood with art.

This, of course, is what raises the specter of gentrification. History shows that the shock troops of gentrification a Starbucks on every corner, a yuppie in every Beamer are the artists, freaks, punks, and queers who move into marginal areas. They happily pay low rent and live in iffy areas so they can create alternative communities. But that success can sow the seeds of a community’s destruction.

What makes the Art Murmurers different from alternative communities of the past is they are well aware of how they can be a mixed blessing for neighborhoods. The night before the April Art Murmur, Murmurers held a five-hour meeting to revisit their founding principles, which include a commitment to a sustainable neighborhood as a way to prevent yuppification.

"We are trying not to alienate the current residents," Silverstein said, while noting the harsh reality of gentrification. "If this neighborhood goes to hell and becomes another Emeryville, I don’t think you can do anything about it."

Silverstein said RPS is proactively linking to, and becoming part of, the community by offering sewing classes, art classes, a community space for events, and by forging a partnership with a local high school so the collective is not just an invasive bohemian Borg.

Silverstein told us she sees more new faces at classes offered by the gallery, a statement backed by the youths of color running in and out of the gallery space. Timmins too sees a role for the galleries to provide a place for art and education for local kids, because they "are not getting it in school."

Other galleries are less clear on the concept of community and gentrification. Esteban Sabar, owner of the upscale Esteban Sabar Gallery, moved from the Castro to affordable Oakland with a grant from the city of Oakland.

"This is affordable for me," Sabar said. "It will take awhile for gentrification to happen. By putting a gallery here I will help artists and the community. I will not let anyone kick me out." But he failed to address what might happen to the poorer local residents already living there if gentrification heats up.

Perhaps Jen Loy, co-owner of Mama Buzz Café, has the most realistic take on the issue. Lower Telegraph isn’t like areas that used to have vibrant communities until they were decimated by dot-commers. She said there were few people living in the area.

"The more people, the better," Loy said. "People [who have been] living here 10 or 15 years are saying, ‘Thank you, it is great to have you here.’" Loy says businesses like a local market, a pizzeria, and the bar Cabel’s Reef all benefit from an influx of capital.

So the question is, as always, who benefits? If an area is revitalized, tax revenues go up, more people move in, and a more vibrant area ensues, but where do the artists and people who were there first go? Will they be able to create a community strong enough to resist displacement?

Or will they do what Tracy Timmins of Auto Gallery has already had to do: "As far as being pushed out, it happens," she says. "If that happens, I start again somewhere else." SFBG

Concerns about public drinking in North Beach and stifled public debate are conspiring to cripple a pair of popular outdoor festivals, possibly creating a troubling precedent for other events at the start of San Francisco’s festival and street fair season.

"We’ll have to cancel this year’s festival," Robbie Kowal, who runs the North Beach Jazz Festival, said of the possibility of not getting his alcohol permit. "Seventy-five percent of our funding comes from the sale of alcohol."

The Recreation and Park Commission’s Operations Committee is set to review the jazz festival’s permit May 3, and if sentiments among the three mayor-appointed commissioners haven’t changed, they might not allow Kowal and his partners, John Miles and Alistair Monroe, to set up bars and serve drinks to local jazz fans in Washington Square Park, as they’ve been doing without challenge for the past 12 years.

"We’ve never even had a hearing to get a permit before," Kowal said. "We’ve had no arrests and no [California Department of Alcoholic Beverage Control] violations. We’re being punished when we haven’t done anything wrong. We’re caught up in this whole North Beach Festival situation."

Kowal was referring to a dispute involving the neighborhood’s other popular street fair, the North Beach Festival, a 52-year street fair that had its permission to sell alcohol in the park yanked this year. The festival is hosted by the North Beach Chamber of Commerce, whose director, Marsha Garland, is a political adversary of the area’s supervisor, Board of Supervisors president Aaron Peskin.

The problem started when parks general manager Yomi Agunbiade determined that a long-standing ban on alcohol in city parks should also apply during festivals. Two out of three members of the Rec and Park Commission’s Operations Committee agreed with that ruling during an April 5 meeting, and it became official policy.

Then, as the North Beach Festival permit went to the full commission for approval April 20, the words "permission to serve beer and wine" disappeared from the agenda item. Those words had appeared on an earlier version of the agenda, allowing the commission to grant what Garland had received with every permit for the last 20 years. The agenda change meant the commission couldn’t even discuss the alcohol issue, let allow issue a permit that allowed it.

Commissioner Jim Lazarus questioned a representative of the City Attorney’s Office about it and was told that the full commission couldn’t hear the policy if the general manager and Operations Committee were in agreement.

"I was taken aback by the fact that the full request of the applicant to serve beer and wine was not on the calendar," Lazarus told us. "I’ve been on the commission for three and a half years, and I’ve never seen that happen before for this kind of issue."

This story is still unfolding, but observers are openly wondering whether this is an isolated case of political sabotage or whether this battle over beer could hurt the summer festival season.

Wine and beer sales have always played a critical role in the financial viability of many of the city’s summer festivals. In a city that’s never been afraid of a liberal pour, many are beginning to wonder if the good times are over, and if so, why?

"The Rec and Park meeting was so disheartening, and if it’s used as a precedent in any way, it will harm other events. If the oldest street fair in this city can be chipped away at like that, who’s next?" said Lindsey Jones, executive director of SF Pride, the largest LGBT festival in the country.

Some North Beach residents think this Rec and Park procedural shell game is punishment for Garland and her organization’s opposition to Peskin, whom they blame for the change.

"Aaron Peskin would like to take Marsha Garland’s livelihood away," said Richard Hanlin, a landlord and 30-year resident of North Beach who filed a complaint over the incident with the Ethics Commission.

"They want to railroad Marsha," said Lynn Jefferson, president of the civic group North Beach Neighbors. "They want to see her out of business. If she doesn’t have those alcohol sales, she’ll personally go bankrupt."

At the heart of the Garland-Peskin beef is a 2003 battle over a lot at 701 Lombard St. known as "the Triangle," which the owner wanted to develop but which the Telegraph Hill Dwellers wanted for a park after they found a deed restriction indicating it should be considered for open space. Peskin agreed with the group he once led and had the city seize the land by eminent domain, drawing the wrath of Garland and others who saw it as an abuse of government power.

Peskin told the Guardian that it’s true he doesn’t care for Garland, but that he did nothing improper to influence the commission’s decision or agenda. However, he added that he’s made no secret of his opposition to fencing off much of the park to create a beer garden and that he’s made that point to Rec and Park every year since the festival’s beer garden started taking over the park in 2003.

“Just let the people use Washington Square Park. It’s the commons of North Beach,” Peskin said. “The park should be open to people of all ages 365 days a year. That’s just how I feel.”

Yet Peskin said that neither the North Beach Jazz Festival, which doesn’t segregate people by age, nor festivals that use less neighborhood-centered parks, like the Civic Center and Golden Gate Park, should be held to the same standard. In fact, he plans to speak out in favor of the jazz festival’s right to sell alcohol during the May 3 meeting.

Access became the buzzword this year, in response to last year’s decision by the San Francisco Police Department to gate two-thirds of the park off as a beer garden, effectively prohibiting many underage festivalgoers from actually entering a large part of the park. The section near the playground remained ungated, but many families were disillusioned by the penning of the party.

Enter the North Beach Merchants Association, a two-year-old rival of the Chamber of Commerce with stated concerns about booze. President Anthony Gantner learned that the park code banned alcohol from being served in any of the parks listed in Section 4.10, which includes Washington Square as well as nearly every other greenway in the city, unless by permission of the Recreation and Park Commission, which should only be granted as long as it "does not interfere with the public’s use and enjoyment of the park."

Gantner and Peskin both argue that the beer garden does interfere with the right of those under 21 to use the park. "The Chamber is basically doing a fair, and that’s it," Gantner said. "A lot of its members are bars, and they run a very large fair with beer gardens that result in incidents on the streets for merchants."

Though Garland contends that the festival is an economic stimulator, resulting in an 80 percent increase in sales for local businesses, Gantner claims that a number of businesses don’t benefit from the increased foot traffic. He associates alcohol with the congruent crime issues that crop up when the clubs let out on Broadway, and thinks that selling beer and wine in the park only accelerates problems in the streets after the festival ends at 6 p.m.

Gantner has the ear of local police, who are understaffed by 20 percent and looking for any way to lower costs by deploying fewer cops. "It used to be we could police these events with full staff and overtime, but now we’re trying to police them with less resources, and the events themselves are growing," Central Station Capt. James Dudley said.

He’s also concerned about the party after the party. The police average five alcohol-related arrests on a typical Friday night in North Beach, most after the bars close. But those numbers don’t change much during festival weekend, leading many to question the logic behind banning sales of alcohol in the park. Besides, if sales were banned, many festivalgoers would simply sneak it in. Even one police officer, who didn’t want to be named, told us, "If I went to sit in that park to listen to music and couldn’t buy beer, I’d probably try pretty hard to sneak some in."

At the April 20 Rec and Park meeting, Garland presented alternative solutions and site plans for selling beer and wine, which represents $66,000 worth of income the festival can’t afford to lose. Beyond her openness to negotiations, Rec and Park heard overwhelming support for the festival in the form of petitions and comments from 30 neighbors and business owners who spoke during the general public comment portion of the meeting.

Father John Malloy of the Saints Peter and Paul Church, which is adjacent to the park, spoke in support of Garland’s request. "I think I have the most weddings and the most funerals in the city," he said. "I’m praying that we don’t have a funeral for the North Beach Festival. If anyone should be against alcohol, it should be the priest of a church."

So who are the teetotalers? Testimony included 10 complaints from members of the Telegraph Hill Dwellers, Friends of Washington Square, and the North Beach Merchants Association, as well as Gantner and neighborhood activist Mark Bruno, who came down from Peskin’s office, where he was watching the hearing, to testify.

Commissioner Megan Levitan said, "If anyone knows me, they know I like my wine," before going on to explain that she was born in North Beach and even used to serve beer at O’Reilly’s Beer and Oyster Festival. However, she said, she’s a mother now, and parks are important to her.

"It does change a park when alcohol is there," she said. "I do not believe we should serve alcohol in the park."

Will that still be her stance May 3 when the North Beach Jazz Festival requests its permit? The jazz fest has never had beer gardens, and the organizers don’t want them. Instead, they set up minibars throughout the park, which remains ungated, allowing complete access for all ages.

Although there is hired security and local police on hand, by and large people are responsible for themselves. The organizers say it’s just like going to a restaurant for a meal and a drink, except in this case it’s outside, with a stage and free live music.

Though Kowal remains optimistic, he’s rallying as much support as possible, even turning the May 3 meeting into an event itself on his Web site (www.sunsettickets.com). His partners, Monroe and Miles, were concerned enough to swing by City Hall to see Peskin, who agreed to testify and help the Jazz Festival retain the right to sell booze.

"The first person to write a check to start this festival was Mayor Willie Brown," Kowal said. "Peskin has always been a big supporter of the festival, which is why we think it will all work out."

The festival is a labor of love for the three organizers, who barely break even to put the event on; after expenses are covered, any additional profit from the sale of alcohol is donated to Conservation Value, a nonprofit organization that aids consumers in making smart purchases.

"We were the first fair to use Washington Square Park," Monroe, the founding father of the jazz festival, said. "We’re standing up for the right to access the park. It’s not about ‘he said, she said’ or who did what to whom. It’s about hearing free live music."

So now comes the moment when we find out whether this is about alcohol, parks, or simply politics, and whether future street fairs could feel the pinch of renewed temperance. If the jazz festival gets to sell booze, Garland’s supporters argue, that will represent a bias against the North Beach Festival.

The commission will hear Garland’s appeal at the end of May, just two weeks before the festival begins. With contracts already signed and schedules set, the stakes are high. Owing to lack of funds, Garland has already canceled the poetry, street chalk art, and family circus components of the fair. She did receive an e-mail from Levitan promising a personal donation to put toward the street chalk art competition. Even so, she’s preparing for a funeral.

And if alcohol is prohibited at the jazz festival, it could send out a ripple of concern among street fair promoters and lovers around the city. To be a part of the decision, stop by the meeting and have a say. SFBG

PS This weekend’s How Weird Street Faire, on May 7, centered at Howard and 12th Streets, will have beer gardens in addition to seven stages of music and performances. But organizers warn that it could be the last festival because the SFPD is now demanding $14,000, a 275 percent increase from the police fees organizers paid last year.
