Burrito will eat you

Ed Note: We know this is a little late, breaking-news-wise, but we just can’t seem to get over it. Especially while we’re eating canned spinach for lunch.

Boy, am I glad there are no Hardee’s restaurants in California, or I’d have to eat one of these:

That’s the Country Breakfast Burrito, made, according to www.hardees.com, with “2 loaded omelets, 5 hashrounds, shredded cheddar cheese, and sausage gravy.” Just so you know, a “loaded omelet” has eggs, bacon, and ham in it. Which, in layman’s terms, is 920 calories and 60 grams of delicious, pork-based fat. Which, really, is not a whole lot, compared to eating a whole suckling pig, or a Hardee’s chicken salad, which has 1100 calories and 83 grams of fat. I mean, at least the breakfast burrito won’t dupe you into thinking you’re making the healthy choice by getting the salad. Hell no–there’s no fuckin’ vegetable matter up in this bitch. Lettuce is for suckers. This is the type of thing you order and say, “I’m gonna order that, eat half of it while watching football, get a little comatose, maybe wake up and finish it and/or barf, and/or barf and finish it, then watch some more football, maybe jerk off to porn, and go back to sleep.” It’s not a bright-eyed and bushy-tailed, gonna start the day right menu item, here, folks. It’s a plan of your Sunday. It’s a low-cost vacation in a tortilla, friends. Look at the gravy and cheese oozing out of that thing…if that doesn’t scream “relaxation,” I don’t know what does.

Green City: Saving people and the planet

GREEN CITY The average young person doesn’t pay much attention to things like wind turbines and energy efficiency. Friends and family, yes. School or work, sure. Green technology? Probably not. And for youths in underserved communities, where violence and economic hardship are a backdrop for everyday life, the likelihood of thinking green is even lower.

Enter activist groups like the Oakland’s Ella Baker Center for Human Rights, and watch as things begin to change. Under the leadership of cofounder Van Jones, the Ella Baker Center has received widespread attention for its role in the development of the Oakland Green Jobs Corps program, set to begin in early 2008.

The Green Jobs Corps will provide training opportunities for hard-to-employ populations (read: at-risk youths, low-income people, and those formerly incarcerated) while supporting the development of a greener economy. It’s no small task. For decades the environmental community has looked for ways to make green relevant to marginalized communities. And it hasn’t been that successful. Ian Kim, campaign director for the Green Jobs initiative, says the program is significant in that it bridges the gap between the environmental and social justice movements.

"The connections are obvious once you start to look at them," Kim told the Guardian. "Just as there are no throwaway resources or species, there are no throwaway people or communities."

The Ella Baker Center has worked closely with the International Brotherhood of Electrical Workers to anchor a larger coalition of activists called the Oakland Apollo Alliance. Together, these groups are propelling the initiative forward. The collaboration is a significant one. Historically, labor activists and environmentalists have been at odds. The assumption: there can be good jobs or a clean environment, not both. Victor Uno, a spokesperson for the IBEW, says that dynamic is changing.

"We think it’s important to partner with community groups, and we need alliances with environmental groups," Uno said. "Economic growth is going to mean green jobs, and we’re working together to create opportunities for people who have been historically locked out."

The Green Jobs Corps program received $250,000 in seed funding from the Oakland City Council in June — part of $2.3 million of unspent settlement funds the city received after the California energy crisis nearly a decade ago. The program will be administered through Oakland’s Community Economic Development Agency, and job training will focus initially on renewable-energy technology and efficiency — a requirement of the settlement funds. Forty young men and women are expected to participate in the nine-month program, which includes six months of training, a three-month paid internship, and services like case management and job placement. Kim says the likelihood of participants obtaining well-paying jobs afterward is good.

"Green-collar employers have jobs that pay a living wage, have benefits and good working conditions," he said. "They offer career ladders and real pathways out of poverty."

While recruitment for the program has not yet begun, Kim is aware that the initial draw will likely be the word job and not the word green. Still, it’s progress.

"There’s no shortage of people looking for job training," Kim said. "It’s within the course of the program that they’ll receive education about environmental awareness and sustainability. We need to educate people where they’re at."

Late last month the Ella Baker Center took the Green Jobs training initiative to the national arena by launching the Green for All campaign.

"We have definitely realized the green job idea is too big for one organization or one group," Kim said. "It’s turning into a really big movement with a lot of players."

The launch comes shortly after Congress approved the Green Jobs Act of 2007 (HR 2847) as part of the proposed energy package. It is legislation that would direct millions of dollars toward green job training and is now awaiting approval or, more likely, a veto from President George W. Bush. Kim said defeat wouldn’t be a surprise.

"We’ll just come back next year," he said. "We’ll come back with more political will and more ideas. There’s a lot to look forward to."

Airlines demand corporate welfare

The major airlines that serve the Bay Area, with the help of the Hotel Council of San Francisco, are trying to get out of paying millions of dollars in taxes to the city by claiming the right to use a law that was designed to help San Francisco’s poorest residents. And they’re threatening to prevent their employees from staying in the city if the Board of Supervisors doesn’t acquiesce to the corporate welfare demand.

At issue is the city’s 14 percent Transient Occupancy Tax, which is paid by hotel guests. It is the third-largest source of local tax revenue, after property taxes and payroll taxes, bringing in $177 million in the last fiscal year. The only major exemption from the tax is for permanent hotel residents, generally those on the brink of homelessness who live in the run-down single-room-occupancy hotels for months or even years on end.

Major airlines house hundreds of their employees in San Francisco’s hotels each night. They are arguing that because of past court rulings on corporate personhood — in which judges have deemed that corporations have the same rights as individuals — the airlines should be exempt from paying the tax when they rent blocks of rooms for their employees.

The airlines, in collusion with some hotels in the city, have long used the exemption to avoid paying taxes on many of the rooms they rent (about two-thirds, according to the Hotel Council, which translates into millions in lost city revenue every year). A few years ago city officials told the corporations that the exemption didn’t apply to them and that they should be paying the tax.

Enacted in 1960, the Permanent Resident Exclusion exempts from the tax individuals who occupy or have the right to occupy the same hotel room for at least 30 consecutive days. “We looked at the legislative history, and it was clearly put there to help formerly homeless people,” Treasurer José Cisneros told the Guardian. “The city has always said that 30 consecutive one-night stays are not the same as a 30-night stay by an individual.”

The hotels and airlines challenged that interpretation and had their case thrown out of court. So now they’ve turned to the Board of Supervisors in the hope that they can win this chunk of corporate welfare by using threats of an economic exodus.

 

CORPORATE SHAKEDOWN

In October 2004, American Airlines and the San Francisco Hilton filed a lawsuit against the city arguing that airline crew members staying in San Francisco hotels qualified for an exemption from the hotel tax. The lawsuit was dismissed in May 2006 without going to trial, with Superior Court Judge James Warren ruling that the plaintiffs “did not assert and did not present any evidence that any particular room at the Hilton was continuously registered to American Airlines for more than 30 days.”

To clarify any ambiguity in the law, Cisneros in May issued an interpretation stating, “Although an agreement between a person and a hotel may require that the person pay the hotel for a minimum number of ‘guaranteed’ daily reservations for the person’s employees over a period of time longer than 30 days, such an agreement does not create any permanent resident exemption for any guest rooms unless the above criteria are satisfied,” referring to criteria that include “a person is a registered hotel guest” and “that person or any of that person’s employees continuously occupy or have the right to occupy the same room for 30 days or more.”

Yet now, at the request of Sup. Michela Alioto-Pier, the Board of Supervisors’ Government Oversight and Auditing Committee has scheduled a Nov. 19 hearing for the purpose of “explor[ing] the unintended consequences of this decision, including the loss of revenue to the City when the airlines inevitably move their crews to another location in the Bay Area where room rates are more competitive.”

That implied threat comes from Hotel Council executive director Patricia Breslin, who paints a doomsday scenario if the airlines have to pay the hotel tax on every room they rent. Breslin warns that if the Board of Supervisors does not offer concessions to the airline industry, it could bring about an “economic tsunami” that would hit hotels, restaurants, and city government.

Airline employees occupy an average of 1,050 hotel rooms per night in San Francisco, according to Smith Travel Research, an information and data provider for the lodging industry. Given that the tax is collected by the hotels, Cisneros doesn’t have data on how much the airlines should be paying the city. But assuming the airlines negotiate rates of about $100 per night, that would translate into more than $5 million per year.

“We pushed so hard to get them to pay it that they sued us,” Cisneros told us.

Breslin said the airlines have been paying about $1.7 million per year in hotel taxes and that sales taxes generated by airline employees bring another $1.4 million into the city, all money that would be lost if the airlines go elsewhere. She said the airlines have threatened to begin putting their employees in hotels in Peninsula cities near the airport, like Burlingame, San Mateo, and even San Jose, to cut costs. Already Mexicana Airlines has stopped using San Francisco’s hotels for its employees. Other airlines, such as Virgin Atlantic, United, Cathay Pacific, and Lufthansa, have threatened to follow suit.

Breslin said hotels would be forced to lay off cleaners, servers, and other low-income workers due to the loss of business that would accompany the exodus of airline employees. San Francisco, she argues, would “lose a significant revenue stream” if the airlines lose their appeal.

“It will change the economics of San Francisco,” she told us. “This is not a frivolous issue.”

 

CALLING THEIR BLUFF

Granting the exemption would cost the city millions of dollars, but that isn’t the only reason being offered for opposing the gambit. Some city officials simply don’t believe the airlines — or their employees, most of whom are union members, many of whom have contracts specifying their accommodations be in urban centers — will abandon San Francisco.

Sup. Chris Daly, who is on the Oversight and Auditing Committee, is against granting the exemption to the airlines. “They blow smoke all the time,” he told us, referring to major industries such as the hotel and airline industries. “That’s how they get away with not paying taxes.”

Cisneros argues the airlines’ threat to move their employees into suburban hotels isn’t logical, noting that San Francisco hotel rooms are already far more expensive than their suburban counterparts — with or without the hotel tax — and the airlines have always chosen to keep their employees here anyway.

“I just don’t think the threat is realistic at all,” Cisneros said. “If they were basing their decision on which hotels are cheapest, they would have never been staying in San Francisco.”

Recently compiled data and trends in tourism and hotel occupancy rates also suggest that Breslin’s warning of a crippling economic backlash are unfounded. According to an August article in the San Francisco Business Times by Ryan Tate, “Next year promises to be by far the most robust for leisure and business travel in San Francisco since the dot-com boom.”

He continues, “Convention business will reach more than 900,000 hotel rooms in 2008, well above the 740,000 room nights booked by conventions in 2007.” The San Francisco Convention and Visitors Bureau forecasts that overall tourism will top 16 million visitors next year and that visitor spending will exceed last year’s record $7.8 billion.

The taxes the city collects from hotels go toward funding a wide range of public services. Some of the money is earmarked for the Convention and Visitors Bureau and for maintaining convention facilities. Some funds are allocated for low-income housing and rent supplements. The War Memorial Department, the Asian Art Museum, and the Arts Commission all receive funding through the hotel tax as well, with excess dollars poured into the city’s General Fund.

San Francisco’s tourism industry is the city’s largest industry and its second-largest employer, after the city and county government. “You want to make sure your number one industry is protected,” Breslin told us.

Yet the policy that she’s asking the city to enact runs counter to the policies in other major cities, including those thought to be less politically progressive than San Francisco. In Los Angeles, for example, only individuals can be granted exemptions from paying the hotel tax. In Chicago the exemption is even stricter and only applies to people who use hotel rooms as their domicile.

Sutter’s assault on the Mission

So as some of us expected, Sutter Health now wants to effectively shut down St. Luke’s hospital in the Mission and turn it into an abulatory clinic.

That’s terrible news for the southeast neighborhoods; St. Luke’s is the only hospital other than SF General in the Mission area, and when St. Luke’s stops taking patients, they’ll all be shuttled to the already overcrowded public hospital.

Sutter is supposed to be a nonprofit, but it acts like a greedy corporation. The problem with St. Lukes is that it gets a lot of uninsured and Medi-Cal patients; Sutter only likes rich patients with good health plans.

Let’s hope the supervisors remember this when the assholes from Sutter come along and ask for permission to build a giant new hospital on Van Ness.

If you’ve ever been to Chaya, the Japanese restaurant on Valencia and 19th streets, then you’ve seen Omer (last name withheld). He’s the little short guy with the crusty Joe-Dirt mullet who pops out of the shadows with a guitar and scares tourists. Omer’s confrontational approach to panhandling seems counterintuitive, but he has found success with Mission-district locals who get off on watching tourists shit their pants when he attacks them with his vicious renditions of classic rock hits.

I tried to do a regular interview with Omer, but he refused to directly answer most of my questions. That said, I did manage to get some valuable information out of him, and was happy to leave the interview without getting spit on or mauled, which is what I always thought would happen if I ever got close enough to shake Omer’s hand. He’s a pretty funny dude actually… and not mean at all.

41st Anniversary Special: Bilking the links

By now, even most nongolfing residents of San Francisco have heard the dire refrain coming from City Hall: San Francisco’s public golf courses are sucking millions of dollars from the city treasury! Dozens of media stories have trumpeted this bleak pronouncement, and city leaders are using the shortfall to push for outsourcing control of the century-old open spaces. But a Guardian review of the Golf Fund shows that the links are not nearly as down-and-out as pro-privatization forces have led us to believe.

Recreation and Park Department accounting documents we obtained show revenues at the city’s six publicly owned golf courses last year were up nearly $1.5 million from 2005 to 2006 and more than $2.2 million dollars from 2004 to 2005, an increase of nearly 30 percent. But the cost of a lavish contract with a large, out-of-state golf-management corporation has risen precipitously over the same time frame and drained most of these new funds.

For the 2006–07 fiscal year the city shelled out more than $3.25 million to Kemper Sports Management to operate the pro shop and clubhouse at the Harding Park Golf Course and its nine-hole neighbor, Fleming. By comparison, in 2004–05, Kemper’s tab at Harding and Fleming was a still eye-popping $2.07 million, but that number is nearly $1.2 million less than what the city had to pay last year. These increased costs, as well as a hefty loan repayment for Harding Park’s botched remodel in 2002 and 2003, have eaten up the links’ improved revenue and forced the city to throw in an extra $1.4 million from the General Fund to keep golf solvent.

"What’s going on up at Harding is a disaster," Bob Killian told the Guardian. Killian ran the city’s golf operations profitably for two decades until 2001. "When I was in charge we had contracts with various managers for the pro shops and the restaurants, and they made us money. They paid us. Now, Harding is run at a deficit. Where the fuck is the money going? What’s it for? Nobody knows. It’s all this big secret…. It’s a scandal."

Kemper’s seven-year deal is unique, to say the least. At every other publicly managed course, the city leases control of the pro shops and clubhouses to outside companies. In exchange for a flat fee paid into city coffers, those companies bear all of the risk and reap most of the rewards of operating the facilities. But at Harding, the city pays Illinois’s Kemper $192,000 per year, regardless of its performance, to act as an on-site manager, plus a 5 percent incentive fee for gross revenues over $6 million. But those guaranteed sums are only the beginning of the bill.

Kemper hires staff, rents golf carts, and orders the supplies to be sold in the pro shop and the clubhouse. Unlike in the city’s lease arrangements at other courses, though, the company bears none of the risk. It simply invoices the city for its expenses, and the city signs the tab. And the tab just keeps growing.

One public-golf insider who declined to be identified for fear of retribution said, "They’ve got this enormous staff there, managers and assistant managers and assistants to assistants of managers. It’s a golf course, not a hospital! I hear the payroll for the restaurant alone is like $600,000. And it’s only open for one shift a day…. They stock their pro shop with top-of-the-line gear that just sits there. If they order 20 Arnold Palmer shirts and only sell two, who cares? The city still pays for all 20."

In an e-mail to the Guardian, Kemper’s general manager at Harding, Steve Argo, told us it has between 60 and 80 employees, depending on the season. Citing this seasonal variability and "competitive reasons," he did not break down those numbers between management and nonmanagement, as we requested.

Both Argo and Katharine Petrucione, Rec and Park’s chief financial officer, attributed much of the added costs at Harding to the opening of a new permanent clubhouse there in late 2005. Argo said the increased revenues from the clubhouse have "more than covered the city’s increase in payments." But while Rec and Park’s ledgers do show that concessions revenues at Harding and Fleming have gone up since the clubhouse opened, the increase in Kemper’s bill has gone up nearly as much. All in all, with Kemper’s multimillion-dollar deal and loan payments for the over-budget remodel at the course, accounts still put the course at more than $500,000 in the red — even though a round of golf there now costs well over $100 and Kemper is still making a handsome profit.

It doesn’t end there. Petrucione said Kemper’s contract costs taxpayers even more than meets the eye. Because the company submits monthly and yearly budget projections as well as reams of invoices and expenses for reimbursement, Rec and Park staffers spend hours examining Kemper’s paperwork and activities — essentially managing the manager. When we asked her for an accounting of how much the Kemper contract costs the city in staff hours for these oversight duties, Petrucione replied, "It definitely requires more time and effort … than a lease agreement [like those at every other course] would."

During a recent radio interview, Sup. Jake McGoldrick called Rec and Park’s deal with Kemper "the worst contract I’ve ever seen." He added, "We don’t have a golfer problem. Golfers are coming out and playing. We have an accountancy problem."

The golf insider we spoke with echoed McGoldrick’s sentiments: "Business is up like 30 percent this year, but Kemper’s contract is jeopardizing the whole department…. If we redid the greens, tees, and fairways [at the other courses], just Band-Aid stuff like that, we would have the premier municipal system in the country. But instead they’ve given this cushy deal to a company from Chicago with no connection to San Francisco. It’s so unfair."

Despite the controversy over Kemper’s all-expenses-paid arrangement, Mayor Gavin Newsom, Rec and Park general manager Yomi Agunbiade, and others at City Hall have been using the deficits largely brought on by Kemper’s contract to push for more private control of the city’s links. In June the Mayor’s Office put forward a plan to outsource not just clubhouse and pro-shop management but all golf operations at the city’s premier courses, including Harding. The proposal was tabled after several contentious hearings at the Board of Supervisors, but many observers expect that it will make its way back to the board in the near future.

"In a perfect scenario, the city could [manage the courses efficiently], but the city has proven that it doesn’t have the ability to do it," Sup. Sean Elsbernd told us in July. Elsbernd has been one of the most vocal supporters of bringing in private golf management.

But McGoldrick, Killian, and other opponents of the idea point out that the city provided quality, inexpensive golf for nearly 100 years. They worry that private managers will find profit in higher greens fees, more part-time workers, and lower salaries and fewer benefits for full-time staff. But beyond those concerns, they see the mayor’s plan as yet another example of publicly owned assets being offered up for private gain.

The courses, McGoldrick told us, are "priceless…. We can’t just dump [them] because you’ve got folks from the Mayor’s Office and his Rec and Park Department who don’t want to be bothered."

In his endorsement interview with the Guardian, Newsom said about the golf courses, "You gotta deal with the reality of where we are and what our core competencies are. Golf courses do not reflect a core competency of government. We’re losing hundreds of thousands of dollars and about to lose over a million dollars a year, and that comes from somewhere. So rather than continuing to do what we’ve done and hope for a different result, we’re looking at best practices across the country and finding ways to manage our assets differently, and I’m not apologetic for exploring those things."

Bigger is (mostly) better

REVIEW Moving from the small ODC Theater to the much larger Kanbar Hall of the Jewish Community Center of San Francisco seems to have been a good idea for Benjamin Levy’s LEVYdance. At the opening of its home season Oct. 12, a large crowd seemed curious to see what else the young choreographer has in his palette. The good news is that Levy has no intention of repeating himself. The two world premieres, Nu Nu and Bone Lines, showed him stepping outside his previously hyperkinetic fierceness and embracing a more imagistic approach to dance making. Nu Nu is a candy-colored romp for four dancers set to music by rapper Fabolous, jazz singer Peggy Lee, and British songstress Anita Harris. The more ambitious Bone Lines, however, looked curiously unfocused; it didn’t sustain itself, Colleen Quan’s transparent and fragmented costumes notwithstanding.

Nu Nu‘s fast-paced mix of clowning, glamour-puss posing, and blossoming and breaking relationships was clever, smartly paced, and unpretentious.

Oral imagery permeated Bone Lines, which suggests a physical though inchoate passing of knowledge from one body to another. The piece examines Levy’s relationship with his immigrant parents; he seems much more interested in the process of his absorbing that knowledge — fragmentarily, unconsciously — than in any specific facts. The music and sets were strong, and so were recurring motifs of connectedness, but structurally, Bone Lines felt shadowy.

Why, umpteen zillion years into the AIDS era (I used to volunteer for Gay Men’s Health Crisis in the 1980s), is there still no useful data about the risks of oral sex for men? Have we really learned nothing since the first appearance of "Low risk but not no risk"? With the understanding that not letting someone come (or precome) in your mouth is a start (but also loses a lot of the appeal), is there any sensible way to assess and reduce the risks of the common American blow job?

Dear Loyal:

Actually, the relative risks of the Great American Blow Job have been much on my mind of late. I’m working on an article about whatever happened to the heterosexual AIDS epidemic and what straight, middle-class ladies should do about HIV when they start dating again after their marriages break up. (Quick answer: nothing. They’re not going to encounter any, but while they’re taking unnecessary precautions against HIV they’re incidentally protecting themselves from real menaces like human papillomavirus and herpes.) Not that this applies at all to your question or your demographic; what’s sauce for the goose, after all, is not necessarily sauce for gander and gander.

Back when you were first volunteering in New York and I was out here gearing up to become a sex educator, nobody knew nothin’, and the safest thing to do was to lump everything that might possibly be dangerous into "Thou shalt not" and try to get people to take a "100 percent safe" pledge. I suspect that then, as now, the people most likely to achieve 100 percent safety weren’t at much risk to begin with, while the hard partiers continued to party hard-ly, no matter what their T-shirts said. I know for a fact that politically aware womyn at the time would not shut up about woman-to-woman transmission, which turned out to be so much poppycock — or poppyhen, as they might have had it. Likewise, the much-ballyhooed heterosexual AIDS epidemic never made it off the cover of the news magazines and into the bedrooms and bloodstreams of straight America.

So, your question. If there were a definitive answer to that, it would be coming out of a few labs here in San Francisco. But of course, HIV being a shifty bugger and human behavior being even worse, there isn’t. There are animal studies (using simian immunodeficiency virus, which is similar but by no means identical) demonstrating that you can easily spread the virus by swabbing monkey tonsils with an infected Q-tip. Then there are the epidemiological studies like HOT, the HIV Oral Transmission study, dedicated to finding those cases in which a guy gave blow jobs but never, ever, ever had unprotected anal sex and seroconverted anyway, and that is so complicated a business I’m going to let one of the researchers explain it:

"I’m going to conclude with the HOT study, in which, again, we interview men who we screen and rescreen to ascertain that, in fact, their only risk is oral sex. So they are a special population, and they are screened and rescreened, and they get their HIV test, and eventually we do another very in-depth interview, and after three corroborating screenings, or two screenings and one interview in which they say they’ve only had oral sex, 25 percent later report a higher risk exposure — anal sex in the same time period — after we get them in another environment with a different questionnaire and a face-to-face interview, and this is after they’ve been told that, in fact, they’re negative. And so we see this working many ways, and they’re, like, ‘Whew! Well, now I can tell the truth.’ But in fact, of those 363 men, we estimate that up to a quarter of them probably weren’t having only oral sex, and so I think that we have huge problems in terms of self-reported risk behavior."

That was from a very informative experts’ roundtable discussion I found on HIV Insite (hivinsite.ucsf.edu), a UC San Francisco site I have just declared required reading for the interested. The good news is that the best work currently being done is readily available to us for free. The bad news is that, due not to bad science or lack of science but to the vagaries of human memory and human motivation, they still can’t really answer your question. How many new HIV infections are caused by fellatio to ejaculation? I’ll let the above experts answer that. It’s funny but not, you know?

JK I think we agree it’s less than 5 percent, don’t we?

SB Uh, … yes, I’d probably say it’s — it may be less than 5 percent. I’d say 5 percent or less. But I wouldn’t say 1 percent either.

JK Well, 1 percent is less than 5 percent … [Laughter]

KS Well, I wouldn’t say "5 percent or less."

SB So I don’t know that we’re going to come to consensus on that.

And what’s the best way to reduce whatever risk there is? Not going down on HIV-positive men. Easy for me to say, sure, and awfully glib, but you can’t say it ain’t so.

41st Anniversary Special: Wrecked park

The San Francisco Recreation and Park Department has a long history of maintaining parks, community centers, and other recreational offerings. In fact, it controls more land in the city than any other entity, public or private. But after seeing its budget repeatedly slashed during lean fiscal years, the underfunded department has become a prime target for some controversial privatization schemes.

There are ongoing efforts to privatize city golf courses, supported by Mayor Gavin Newsom and Rec and Park general manager Yomi Agunbiade (see “Bilking the Links,” page 22). And there are ongoing fears that the city intends to privatize its popular Camp Mather vacation spot, something the RPD studied a few years ago and Sup. Jake McGoldrick has fought and highlighted.

Rec and Park has identified $37 million in needs at Camp Mather — the product of a private study the agency has been unable to fully explain to the public (see “From Cabin to Castle,” 4/4/07) — but left Camp Mather off a big bond measure planned for February 2008.

“They say $37 million you need up here, and how much you got in there for the ballot measure? Zip, zero,” McGoldrick told the Guardian. “It’s a familiar pattern: you underfund the hell out of something, and then you turn around and say, ‘We, the public sector, cannot handle taking care of this.'<0x2009>”

Rec and Park spokesperson Rose Dennis denies there are plans to privatize Camp Mather or that its omission from the bond measure is telling. “Many people disagreed — including you — with the funding needs and whether we could back it up,” she explained as the reason for its omission from the bond measure.

In his Oct. 1 endorsement interview with the Guardian, Newsom said, “We actually made some commitments just this last week with Sup. McGoldrick to help support his efforts, because he’s very protective of Camp Mather, and I appreciate his leadership on this, to help resource some of the needs up there without privatizing, without moving in accordance with your fears.”

And while Newsom said he hoped to avoiding privatizing Camp Mather, he refused to say he wouldn’t: “I’m not suggesting it’s off the table, because I’m not necessarily sure that the conditions that exist today will be conditions that exist tomorrow, and I will always be open to argument.”

But at least the Camp Mather and golf arguments have been happening mostly in public. That’s what voters intended in 1983 when they passed Proposition J, which requires public hearings, a staff study, and a vote by the Board of Supervisors before city services can be privatized. Yet over the past couple of years, there’s been an effort to quietly shift operations at a half-dozen rec centers away from city programs and toward private nonprofits.

It’s called Rec Connect. Its supporters bill it as an innovative effort to bring much-needed recreation programs to underserved, low-income neighborhoods. “This is a pilot program to see if a collaboration between a community-based organization and a rec center yields a richer program and a more engaged community,” said Margaret Brodkin, director of the Department of Children, Youth and Their Families, which created the program and oversees that and other uses of the city’s Children’s Fund.

But to members of the Service Employees International Union Local 1021 — which includes most city employees and has filed grievances challenging Rec Connect — the program is a sneaky attempt to have underpaid, privately funded workers take over services that should be provided by city employees, who are better paid, unionized, and accountable to the public.

“The city took funds from the city’s coffers and gave them to the Department of Children, Youth and [Their] Families,” Margot Reed, a work-site organizer for the union, told the Guardian. “DCYF is using these funds, through Rec Connect, to contract out to private nonprofits work that rec staff were doing for a quarter of the cost.”

Brodkin was the longtime director of Coleman Advocates for Children and Youth — a perpetual thorn in the side of City Hall and the author of the measure that set aside some property taxes to create the Children’s Fund — before Newsom hired her to head the DCYF. She sees her current role as a continuation of her last one, and she sees Rec Connect as an enhancement of needed services rather than a privatization.

“There is a commitment that no jobs would be lost. I’m a big supporter of the public sector,” Brodkin said, while acknowledging that the RPD is chronically underfunded. “I am certainly aware of the resources issue at Rec and Park…. I’d be a happy camper if the Rec and Park budget was doubled. But I’d still believe in this program and say it offers a richer experience.”

Rec Connect began in 2005 with a study that looked at unmet recreational needs and evaluated facilities that might be good places to bring in community-based organizations to offer specialized classes. The whole program was financed through a mix of public funds and grants from private foundations. The three-year pilot program started just over a year ago.

“The Rec Connects,” Newsom told the Guardian, “are a way of leveraging resources and getting more of our CBOs involved and using these great assets and facilities, instead of limiting use to the way things have been done.”

Rec Connect director Jo Mestelle denied that the initiative is a privatization attempt.

“Rec and Park brings the facilities, the sports, and traditional recreation. The CBOs bring the youth-development perspective and nontraditional programming,” Mestelle said. “Hopefully, together we build a community that includes youth-leadership groups and advisory councils.”

Few would dispute the need for more after-school or other youth programs, particularly in the violence-plagued Western Addition, where some of the Rec Connect centers are. But the means of providing these programs is something new for San Francisco, starting with the fact that even though Mestelle works in the DCYF office, her salary is paid for entirely by private foundations.

That relationship and those funders aren’t posted anywhere or immediately available to the public, but Brodkin agreed to provide them to the Guardian. They include the Hellman Family Philanthropic Foundation ($50,000), the Hearst Foundation ($50,000), the San Francisco Foundation ($128,000), the Haas Foundation ($100,000), and the SH Cowell Foundation ($150,000).

Brodkin and Mestelle characterized those foundations as fairly unimpeachable, and Brodkin defended the arrangement as part of a national trend: “The thing that’s odd about SEIU’s perspective is this is happening all over.”

That’s precisely the point, SEIU’s Robert Haaland says.

“It’s been a strategy since the ’70s to, as [conservative activist] Grover Norquist calls it, ‘starve the beast,'<0x2009>” or defund government programs, Haaland said. “On a national level there is a lot going on that impacts us locally.”

Minutes from a recent Recreation and Park Commission meeting confirm that rec center directors have only about $1,000 each year to cover the cost of buying basketballs, team jerseys, referee whistles, and other basic sports and safety supplies. The SEIU grievance also notes that recreation staff positions have decreased by a third just as senior management positions increased by a third.

“We don’t have enough dollars for $20-an-hour rec center staff who are directly responsible for the kids and are well known to the community. We believe kids deserve great coaches, consistency, longevity, and commitment,” Reed said.

SEIU Local 1021 chapter president Larry McNesby is also the Rec and Park manager who oversees Palega Park, one of the Rec Connect sites. He told the Guardian that while his rec directors are “under pressure from the mayor to show him numbers of people that they are serving,” Rec and Park’s new online registration fails to reflect the “hundreds of drop-ins” that rec staff serve on a daily basis.

But he said the department has been set up to fail by chronic underfunding.

“I’d love Rec Connect and DCYF to be on a level playing field, because my directors could out-recreate theirs any day,” McNesby said. “You can’t just eliminate our jobs and replace them with someone who makes just above minimum wage.”

Actually, Brodkin and Mestelle note that negotiations with SEIU over Rec Connect have resulted in a guarantee that no jobs will be replaced and an agreement by the city as to 250 different tasks that the Rec Connect CBOs can’t perform. Still, they say the program brings innovation to a stagnant city agency.

“Before Rec Connect the rec centers always had a Ping-Pong table and some board games, but some of them were really poor, many were tired looking, none had computers or Internet. So we’ve had to think outside the box. Rec [and] Park is a big department, and it’s not always efficient,” Mestelle said.

Public records show that in 2006, the DCYF, whose primary function is to administer grants, sent $1 million in public money to Rec Connect from the Children’s Trust Fund, a pool of cash the city gathers each year by levying 3¢ per dollar of property tax.

Both Rec Connect and city workers stress the importance of offering a range of good programs to young people. “Our work is at a more social level,” McNesby says. “Every minute a kid spends in a rec center is a minute they’re not breaking into a car or victimizing someone or being victimized.”

The question is who should provide those programs. “It’s society’s value system that controls where the money goes,” Rec and Park spokesperson Dennis said. “It’s a really provocative discussion. There are some very compelling trade-offs argued in convincing fashion by intelligent people on both sides. These aren’t easy decisions.”

But the union people say that when it comes to Rec Connect, that discussion isn’t happening in public forums in a forthright way. As Reed said, “Gavin Newsom never went to the voters and said, ‘Here’s what we want to do: cut the rec staff and bring in private nonprofits.'”

Over the past few weeks almost every major news outlet in the country has reported on Blackwater, a private company the US government hired to do work in Iraq that was once the exclusive province of soldiers.

The deal hasn’t gone so well: on Sept. 16, Blackwater guards opened fire and, according to the Iraqi government, shot 25 civilians. The incident set off an international furor and has brought into focus the breadth of the company’s work for the US government. It’s prompted an investigation by the House Committee on Oversight and Government Reform, which showed that since 2001, Blackwater’s federal contracts have increased 80,000 percent. It’s revealed the massive pay inequalities between private security guards and US soldiers — the cost of one private guard could pay the salaries of six soldiers.

And it’s raised a question that’s critical to understanding how government increasingly works in the United States: should a private company be doing the work of the military?

Privatization of public services is all the rage in this country now, at all levels of government, from Washington DC to San Francisco. Supporters say the private sector can often work better and more efficiently than the old, bureaucratic, much-maligned government.

But Blackwater is a great example of the perils of privatization. And there are many more.

STARVE THE BEAST


Over the past few decades governments at all levels in this country have been in a near-perpetual state of deficit. Taxes are way down from their historic post–World War II levels, and except for a brief period during the tech boom, there is rarely enough money for even basic social services.

"It’s been a strategy since the ’70s to, as Grover Norquist calls it, ‘starve the beast,’<0x2009>" Robert Haaland, an organizer with Service Employees International Union Local 1021, told us.

And because politicians, even Democrats, are terrified of tax hikes, they’ve been looking for more efficient ways to use the money they have. The magic bullet goes by many names — privatization, public-private partnerships, competitive outsourcing, creative financing solutions — but the basic idea is to allow the power of competition, set free in an unregulated market, to provide the public with the best services at the lowest cost.

"To do or to buy is the question that all governments face," says Ken Jacobs, director of UC Berkeley’s Labor Center.

We’ve been buying. Since 2000, outsourcing of federal dollars has increased 100 percent, to $422 billion in taxpayer funds in 2006, according to a September study by the Washington DC US Public Interest Research Group. The US government is now the private sector’s largest customer.

San Francisco may be known as one of the most progressive cities in the country, but this town has also been wooed by public-private partnerships with promises of improvements to the golf courses, construction of a new power plant, and funding for the many civic needs we have.

PRIVATIZE MUNI?


Cheerleaders for privatization look at someone like Nathaniel Ford, executive director of San Francisco’s Metropolitan Transit Authority, and see everything that’s wrong with the public sector. Ford’s salary is nearly $300,000, plenty high enough to attract a talented leader. But the Muni system he runs keeps the average San Franciscan waiting on the corner in the morning, delivers that person to work at an unpredictable hour, and lurches them homeward every night aboard a standing-room-only bus. Nobody thinks Muni is performing well.

That makes the case for privatization seem almost appealing.

"The public has been schooled to think that government is the problem, not the solution," Elliott Sclar, professor of economics at Columbia University, told us. In his 2000 book on privatization, You Don’t Always Get What You Pay For: The Economics of Privatization (Cornell University), he writes, "American folk wisdom holds that, by and large, public service is uncaring, unbending, bureaucratic, and expensive, whereas competitively supplied private services such as FedEx are efficient and responsive."

Competition, the privatizers say, drives innovation. Less red tape means more efficiency. A lack of unions and collective bargaining agreements translates to lower labor costs. Large-scale multinational operations can reduce redundancy and streamline their processes — all of which adds up to a lean-running machine.

But this country has a lot of experience with privatization, and the record isn’t good.

One hundred years ago private companies did a lot of what we now call government work. "Contracting out was the way American cities carried out their governmental business ever since they grew beyond their small village beginnings," writes Moshe Adler, a Columbia professor of economics, in his 1999 paper The Origins of Governmental Production: Cleaning the Streets of New York by Contract During the 19th Century. At one time private companies provided firefighting, trash collection, and water supplies, to name just a few essential services.

But according to Adler, "By the end of the 19th century contracting out was a mature system that was already as good as it could possibly be. And it was precisely then that governmental production came to America. The realization that every possible improvement to contracting out had been tried led city after city to declare its failure."

For example, the 1906 earthquake and subsequent fires in San Francisco were what prodded the city to municipalize water service after the company charged with the task, Spring Valley Water, failed to deliver while the fires raged.

In Philadelphia as well as San Francisco, the business of firefighting was once very lucrative — for both the firefighting companies and the arsonists who were paid to set fires for the former to fight. And corruption was rampant. "Large amounts of public contracting out historically created lots of opportunities for fraud and nepotism," Jacobs said.

So public agencies stepped in to provide basic services as cheaply and uniformly as possible. Towns and cities took on the tasks of security with police and firefighting, education with schools and libraries, and sanitation with trash collection and wastewater treatment. Nationally, the federal government improved roads and transit, enacted Social Security benefits, and established a National Park System, among many other things.

And then, about 30 years ago, the pendulum started to swing the other way. Driven by University of Chicago economist Milton Friedman, enacted in a massive policy shift by Ronald Reagan, proliferated by Grover Norquist and the neocon agenda, and fully appreciated by corporations and private companies, privatization came back.

In Reagan’s first term, he cut taxes 25 percent overall; the rich got a 40 percent cut. Domestic spending fell by half a trillion dollars in the 1980s, although any savings were countered by a rise in the defense budget.

Harvard economist Lawrence Summers, quoted in Looking Back on the Reagan Presidency (Johns Hopkins University), put it this way: "The Reagan budgets will influence the government for the rest of this century. Just as the Great Society left an imprint of Federal commitment to help the indigent and equality of opportunity, the Reagan budget deficits will leave an imprint of non-involvement."

Such a massive realignment of money coupled with tax breaks too politically painful to reinstate led to a boom in the outsourcing of public services. Private companies began doing more municipal work, while nonprofit organizations tried to fill the gaps in funding for social services, welfare, housing, health care, and the environment.

The George W. Bush era has seen even more overt outsourcing. These days no-bid contracts are preferred, and at times government services are completely turned over to the private sector in "direct conversions," and the public agency that once did the job is not allowed to compete to keep it. The Washington Post recently reported that no-bid government contracts have tripled in the past six years.

This doesn’t really sound like the competitive free market espoused by the theory of privatization.

FLUNKING THE TEST


To field-test the primacy of privatization, the Reagan administration sponsored a transportation experiment in the early ’80s: Miami’s Metro-Dade Transit Agency got to compete against Greyhound. The two providers were each given five comparable transit routes to manage over three years, and 80 new buses were bought with a $7.5 million grant from the federal government.

After 18 months 30 of the Greyhound buses were so badly damaged that they had to be permanently pulled from service. Passenger complaints on the Greyhound line were up 100 percent, and ridership was down 31 percent over the course of a year.

Why? There was no incentive in Greyhound’s contract to maintain the equipment or retain riders. The company’s only goal was to deliver the cheapest service possible.

The Miami transit contract could have contained clauses calling for regular inspections or guaranteed ridership, but that would have significantly increased the cost of the work — perhaps to the point where it would have been competitive with what the city provided.

That’s an important lesson in privatization politics: when you add the cost of adequately protecting the public’s interest and monitoring contract compliance, the private sector doesn’t look so efficient.

Which is why many say privatization only succeeds as a theory — and why, for all the problems with Muni, no private company is likely to be able to do a better job.

"Market fundamentalists present an idealized, simpleminded notion of competitive markets in which buyers and sellers have equal knowledge," Sclar told us. "Anyone can be a buyer, anyone can be a seller, everyone can evaluate the quality of the good. In this never-never land, that’s often the way the case is made for privatization by this particular group of economists."

In the real world a number of issues arise when a service goes private. "Accountability gets to be a really big problem," Ellen Dannin, professor of law at Penn State University, said in an interview. "There are predictions about how much money will get saved through privatization, but no one ever goes back to check."

The September study by the US Public Interest Research Group profiled several companies that do government work, including Bank of America, LexisNexis, ChoicePoint, KBR (formerly Kellogg, Brown, and Root), General Electric, and Raytheon, and found instances of illegal behavior in all cases. There were often massive errors in the companies’ work.

Bank of America and LexisNexis had security breaches compromising the data of at least 1.5 million customers they were handling for the government. ChoicePoint allowed identity-theft scams amounting to more than $1 million in fraud. KBR overcharged the government millions of dollars for work in Iraq and Kuwait. GE made defective helicopter blades for the US military. Raytheon failed to fully test the systems of new aircraft. These companies are all still employed by the government.

When companies take over services that aren’t typically part of a competitive market, all sorts of unexpected problems occur. Jacobs points to the rash of contracting for busing services in cash-strapped school districts. Not only did costs eventually rise in many places, but when schools tried to go back to providing their own service, the skilled drivers who knew the routes, knew the kids, and were able to do much more than drive a bus were gone.

Sclar and Dannin agree that any service that lacks competition should be public. Sclar presented the example of electricity. "It’s a natural monopoly," he said. "Essentially it’s either going to be a well-regulated industry or it’s got to be done publicly."

Corporations exist to make money. And although graft, mismanagement, and scandal have always been present in City Halls around the country, in the end the legislative, judicial, and executive branches were not designed to generate profits. That alone means contracting out is financially dubious.

Hiring mercenaries is a classic example. "It costs the US government a lot more to hire contract employees as security guards in Iraq than to use American troops," Walter Pincus wrote in an Oct. 1 article in the Washington Post. "It comes down to the simple business equation of every transaction requiring a profit."

As Pincus details one of the many contracts between the security firm and the US, "Blackwater was a subcontractor to Regency, which was a subcontractor to another company, ESS, which was a subcontractor to Halliburton’s KBR subsidiary, the prime contractor for the Pentagon — and each company along the way was in the business to make a profit."

Blackwater charged Regency between $815 and $1,075 per day per security operative. Regency turned around and charged ESS a slightly higher average of $1,100. After that, the costs dissolve into the enormous bill that KBR regularly hands the federal government.

When the US Army is paying the bill the costs are far lower. An unmarried sergeant earns less than $100 a day. If you’re married, it’s less than $200. If you’re Gen. David H. Petraeus, it’s about $500 — less than Blackwater’s lowest-paid workers.

Very little about the Blackwater contracts would be known by anyone outside the company if it weren’t for the federal investigation, since private businesses are not subject to the same public-records laws as the federal government. They don’t have to open their books or publicize the details of their bids and contracts, and they often fiercely lobby against any regulations requiring this, which leaves the door wide open for corruption — which is what brought sunshine laws to government in the first place.

Sclar said that when it’s a good call to contract out, corporations, private companies, and nonprofits should be required to abide by public-records laws in addition to adhering to a five-year wait for employees departing the public sector for the private. "I think transparency should always be the goal," he said. "As much information as possible." If a company doesn’t want to make its records public, he told us, "[it shouldn’t] go after public work."

THE AIDS LESSON


Privatization comes in many forms and emerges for what often seem like good reasons.

In the early 1980s gay men in San Francisco were starting to get sick and die in large numbers — and the federal government didn’t care. There was no government agency addressing the AIDS crisis and almost no government funding. So the community came together and created a network of nonprofits that funded services, education, and research.

"The AIDS Foundation was founded in response to the epidemic at a time when there wasn’t a response from the federal government," Jeff Sheehy of the AIDS Research Center at UC San Francisco told us.

At first, activists all over the country praised the San Francisco model of AIDS services. Over time the nonprofits began to get government grants and contracts. But by the 1990s some realized that the nonprofit network was utterly lacking in public accountability. The same activists who had helped create the network had to struggle to get the organizations to hold public meetings, make records public, and answer community concerns.

That, Sheehy said, shouldn’t have come as a surprise.

"There isn’t that same degree of accountability that you would have" with the public sector, he told us. "SF General is not going to turn you away at the emergency room, but nonprofit hospitals are less and less interested in running ERs."

Sheehy said he’s seen cases where difficult clients have been banned from accessing help from nonprofits. Unlike at public institutions, "the burden is not on the agency to provide the service. It is with the client to get along with the agency," he said.

Sheehy outlines other issues: nonprofits run lean and are more apt to make cuts and resist unionization, which means workers are often paid less, there can be higher turnover, and upper management is often tasked with fundraising and grant writing and distanced from the fundamental work of the group. There’s no access to records or board meetings. "If service takes a sudden downward shift, what can you do?" Sheehy asks. "You can’t go to board meetings. You can’t access records. What’s your redress?"

And that perpetuates the problem of government not stepping up to the plate. More than half of the social services in San Francisco are run by nonprofits, a trend that isn’t abating.

"When the services are shifted from the public sector to the nonprofit sector," Sheehy said, "that capacity is lost forever from government."

THE LOTTERY TICKET


When Dannin teaches her students about privatization, she uses the analogy of personal finance. "If I find my income does not meet my expenses, I can cut my expenses, but there are certain things I have to have," she said. To meet those needs a person can get a second job. In the case of the government, it can raise taxes.

But "that is not an option governments see anymore," she told us. "So the third option is to buy a lottery ticket — and that’s what privatization is."

When a publicly owned road is leased for 99 years to a private company, the politician who cut the deal gets a huge chunk of cash up front to balance the local budget or meet another need. When the new owner of the road puts in a tollbooth to recoup costs, that’s the tax the politician, who may be long gone, refused to impose. What option does the voting driver have now?

Public goods, from which everyone presumably benefits, are frequently and easily falling out of the hands of government and into the hands of profit-driven companies. In New Orleans, charter schools have replaced all but four public schools. In about 15 municipalities public libraries are now managed by the privately owned Library Systems and Services. (In Jackson County, Ore., it’s being done for half the cost, but with half the staff and open half the hours.) At least 21 states are considering public-private partnerships to finance massive improvements to aging roads and bridges. User fees have increased in the national parks as rangers have been laid off and some of the work of park interpretation is picked up by private companies, as is the case with Alcatraz Island.

Dannin also asks her students to consider who really owns a job. The easy answer is the employer. "But there is another claimant of ownership of that job," she says. "That is the public. Employers depend on roads for their employees to drive to work, a public education system to train their workers. They depend on housing, police, the court system, the system of laws. That is a huge amount of infrastructure we tend not to think about.

"We live within an ecosystem. We’re having a hard time seeing that ecosystem, that infrastructure that we’re all in. That’s what your taxes pay for."

GREEN CITY It is easy to become discouraged by environmental problems, but a few San Franciscans are reminding us that we have collective power to make positive change. And we might even have a little fun along the way.

Paul Scott came up with the idea of the San Francisco Climate Challenge, a citywide contest to reduce household energy consumption. Scott is a lawyer and founding member of One Atmosphere — a nonprofit created by North Beach neighbors concerned with sustainability and conservation. "I think a lot of folks are concerned about climate change, but frustrated by the seeming inaction by the government to solve the problem," Scott told the Guardian. "The purpose of the San Francisco Climate Challenge is to give people something they can do right now."

A joint project by One Atmosphere, the Sierra Club, and SF Environment, the Climate Challenge officially starts Oct. 25 and registration ends the day before. Two top prizes of $5,000 (cash!) will be awarded for greatest overall energy savings and greatest percentage reduction in energy use. Winners will be determined by comparing last November’s Pacific Gas and Electric Co. bill with this November’s bill, so participants must pay their own utility bill and have lived in their current home — apartment, condo, or house — for at least a year.

Private residences account for about 20 percent of San Francisco’s carbon emissions, so the SF Climate Challenge is specifically focused on reducing household emissions. "Hopefully, this contest will increase people’s awareness of what they can do and the environmental damage done by normal activities," said Jonathan Weiner of One Atmosphere. "Simple changes can have significant impacts."

And what are some of these simple changes to make at home? Turn off lights when you leave a room, replace incandescent lightbulbs with compact fluorescents, wear a sweater instead of turning up the heat. And something that people often forget is that appliances use energy even when they’re turned off. So plug your television and stereo into a power strip and, when you’re done watching TV or listening to music, turn that power strip off.

"Eliminating unnecessary, wasteful use and being more efficient with the energy we do use is important," said Aaron Israel of the Sierra Club’s San Francisco chapter. "But you don’t have to eat in the dark or live like a monk. There are very easy things you can do if you’re just a little bit more aware."

Contest participants can sign up for the Climate Challenge as individuals or teams. So far, there teams have been created by neighborhoods, social groups, and sports teams. Even the Board of Supervisors has formed a team, with supervisors Michela Alioto-Pier, Aaron Peskin, and Sean Elsbernd already committed to participating. Word on the street is that even the Mayor’s Office may compile a team.

The Climate Challenge is also about building community. "This is an initiative to bring together a bunch of folks around how we, as residents in the city, can do things differently," said Mark Miller of One Atmosphere. "The more we see how we’re connected, the more we see how much we affect each other."

Making simple, painless changes at home is a great place to start taking responsibility for the health of our communities, city, and planet. Hopefully, the San Francisco Climate Challenge will inspire people to think about the environment in terms of the positive changes we can make instead of the overwhelming problems we feel helpless to fix.

"We need to paint a vision of our own lives that is better in the future than it is right now, so we are all motivated to take action," said Cal Broomhead of SF Environment. "How can we transform our neighborhoods so they’re more sustainable? We have collective power to make change."

Dianne Feinstein takes off her gloves

White gloves still haunt Dianne Feinstein’s political life. She has been wearing them ever since she first went to dancing class, and fellow politicians have accused her of refusing to take them off for politics. Her old political allies bring up the image again and again: those little white gloves seem to crystallize their irritation with her Pacific Heights femininity, the world of the Junior League, the chauffeur and the Goody Two Shoes approach to politics. In 1971 during her disastrous campaign for Mayor, she did her best to reach beyond her background. She promised a Hunters Point crowd she’d never shuck or jive. But she was still wearing those little white gloves.

The white gloves are off now. Feinstein learned from her 1971 defeat and she doesn’t want to lose this time around. She is jostling with state senators Milton Marks and George Moscone for first place at the starting gate in next year’s Mayor’s race, and she is no longer a political dilettante operating on intuition and integrity.

The new Dianne Feinstein is a canny political animal, assiduously cultivating the "homeowner vote" in the foggy reaches of the Avenues while nursing along her original liberal constituency. "She’s dropped the Goody Two Shoes act and she’s willing to play hardball politics," one of her fellow supervisors says admiringly. "She’s moving toward the center and she’s getting very good advice."

"How can you be for the vice squad, for police helicopters, against nude shows and for gay rights?" asks Harvey Milk, a gay former candidate for supervisor. "It doesn’t add up."

Staggering with Bukowski

The beer, the day, whatever the reason, [poet Charles] Bukowski is not reading well — with little enthusiasm, little animation, little inflection in his voice, save the long drawl on certain words. He rarely looks up from his script while reading, as if he hasn’t seen the poems before. Hunched over, his glasses reflect the two spotlights and act as mirrors, blocking the audience from his eyes. At his best he is poetical, distant. At his worst, he is an old man reading the news. And finally the warning, "This is going to be my next-to-last poem." A few say "No, no." Bukowski asks, "Are there any questions?" Again, mixed shoutings answer, a few voices mimic animals, and far from the rear, the high nasal voice says "Bullshit". Bukowski replies, "Lay off that cheeeeeep, rot-gut wine or you’re not going to live a weeeeeeek. If the wine doesn’t get youuuuuuu, I might." The crowd likes this. Shifting gears, the poet says, "Any young girls want my phone number — try Joe Wolberg." Several replies follow, many sound dubious, and the poet says, "Okay, Babe-A."

For this world and its languages, Robbins shows an infectious love that is constantly leading him into literary excesses guaranteed to get him hanged in more proper circles. Didactic, discursive, anthropomorphic, loaded with enough outrageous similes to send a basketful to each poet in the American Academy, Even Cowgirls Get the Blues operates on the refreshing premise that the whole world is alive. This book will make you laugh out loud in the elevator. This book should have champagne and tears spilled on it. This book is Cervantes born again. Thank you, Tom Robbins.

The Film Festival

The 20th Annual San Francisco International Film Festival, which was held at the Palace of Fine Arts Oct. 13-24, was another one of those Sacred Monster affairs that exist above and beyond almost anything that can be said about them.

For me, there was the added excitement this year of the Guardian‘s Banned-from-the-Festival status (see Guardian 10/8, 10/22/76). Because of our reporting on the Film Festival last year, the Guardian was not allowed to attend this year’s event on the same basis as the 98 acceptable representatives from the press. But we went ahead and bough some tickets on the sly, and on the nights of the showings I slunk in to take my place in the audience, glancing furtively around to make sure I hadn’t been spotted. As something of a natural-born outsider, I found the role of a party crasher to fit like a glove.

Still, my perspective on the festival has not really changed. I doubt that I could ever really resolve my attitudes about culture to fit the festival’s concept of Culture. Movies are still just movies to me, and charging an extra dollar to see them does not alter that fact.

The Sean Penn-Matt Gonzalez rumor

Wokette’s got this lovely nutty rumor that Sean Penn would give Matt Gonzalez $5 million to run against Gavin Newsom — as a Democrat. SFist picked up, wondering if it’s a joke.

Coupla problems with the item. First of all, Wonkette refers to Gonzalez as a “deputy mayor under Willie Brown,” which would be news to both of them. Second, folks, the deadline for filing as a candidate for mayor passed quite some weeks ago. The only way someone could file now is as a write-in — theoretically possible, but since abstentee voting has already begun, and by the time a campaign got up and running, a sizable percentage of the votes would already be cast, the whole thing seems rather implausible.

I think Wonkette heard some very old gossip and thought it was new.

California’s tough regs reputation undeserved

Big business loves complaining about California’s famously “tough” regulations. But if they exist mostly on paper and there’s no one around to enforce them, than what the hell is big business whining about?

The state legislature gets the best of both worlds as a result. The majority Dems can show the unions how they’re protecting workers by passing new rules on occupational safety, but their big-business donors are appeased when year after year California’s Division of Occupational Safety and Health (known widely as Cal/OSHA) is systematically de-funded and top administrative posts remain vacant.

And now it’s worse than it has been in more than a decade, writes Garrett Brown in the rag Industrial Safety & Hygiene News. (Is this really what we spend our weekends reading?) Brown is a long-time investigator for Cal/OSHA. He notes that inspections have dropped statewide by 35 percent since 1992, and actual citations have declined by 44 percent.

In fact, California has one inspector for every 84,000 workers compared with the average among nearly two-dozen other states of one for every 50,000, according to Brown. (Those Commies in Canada have one for every 10,000.) Huge percentages of violations simply go unabated, and while employers are appealing citations they’ve received – which they commonly do and which are severely backlogged statewide – no one can force them to fix the identified hazards in the meantime.

That’s kind of like allowing someone to continue breaking people’s knees with a baseball bat until they’re proven guilty of the first assault.

The Chauncey Bailey Project

Just as the Chauncey Bailey Project makes its presence known in Oakland and in the U.S. media,
I am off to Miami for an assembly of the InterAmerican Press Association (IAPA), the international free press association for the Americas.

For years, the hardy U.S. journalistic souls who are members of IAPA have helped do resolutions, go on free press missions throughout the Americas, and support impunity projects to investigate the murders of journalists and turn the evidence over to prosecutors and then push for successful prosecutions.

This year, for the first time, I will be pushing the IAPA for help on the deaths of two U.S. journalists who were killed in the line of duty. The first is Brad Will, the New York video journalist who filmed his own assassination last fall while filming violent demonstrations in Oaxaca province in Mexico. The second is Chauncey Bailey, the Oakland editor who was gunned down in August on his way to work at the Oakland Post by a man wearing a ski mask.

The good news is that an impressive array of journalists, news organizations, and journalism schools have come together to form the Chauncey Bailey Project and to take on the job of finishing his reporting on the suspicious activities of the Your Black Muslim Bakery. This coalition has already had some success. The San Francisco Chronicle was asked to join the project, but declined and said that it preferred to do its own reporting.
And so, for the last four days, anticipating the project’s investigative reports, the Chronicle has rolled out extensive and detailed front page stories on the murder.

The investigative team plans to go further and deeper and research the activities of the Bey family empire, which operates the bakery, and their thuggish operations for the past two decades and the protection they have gotten from the Oakland political establishment. “This is a unique collaboration and we hope our work goes beyond Bailey’s murder and reveals broader issues that impact the lives of Oakland’s citizens,” said Robert J. Rosenthal, editorial coordinator for the project and former managing editor of the Chronicle.

This amounts to an unprecedented collaboration among competing news organizations and promises to be the largest collective journalistic project since the Arizona Project was formed 31 years ago following the murder of Arizona Republic investigative reporter Don Bolles for his reporting on the tangled Arizona underworld.

The resulting collaboration and story led to the formation of the group called Investigative Reporters and Editors. But significantly, the Arizona Republic in Phoenix didn’t run the story and a Tucson daily was the only daily in the state to run the story. The New Times, the local Phoenix alternative paper, ran the story, as did the Guardian in San Francisco. The story was widely run in other papers throughout the country.

This time around in Oakland, the hometown media stand fully and publicly behind the Bailey Project. “We cannot stand for a reporter to be murdered while working on behalf of the public,” vowed Dori J. Maynard, president and CEO of the Robert C. Maynard Institute for Journalism Education in Oakland. “Chauncey’s death is a threat to democracy, journalists will not be intimidated. This type of crime cast a chilling effect over our community. We will not be bullied. We have to prove that there is no gain, and hell to pay, when the very structure of society is challenged.”

Moreover, Maynard said that the team would insure that “Chauncey did not die in vain.”

Pete Wevurski, executive editor of the Oakland Tribune, said, “I’m happy that the Oakland Tribune, and our Bay Area News Group-East Bay partners the Contra Costa Times and San Jose Mercury News, are involved in this noble effort and extremely pleased that the Tribune has been able to take a lead role.” Wevurski is also managing editor of BANG-EB. “Chauncey Bailey was a colleague and friend to many of us and we want to honor his work and our profession by picking up the standard that fell the morning he was assassinated. I’m extremely gratified by the numbers and caliber of journalists who have joined the coalition, and I’m astounded by the work they are turning in already.

“The project is essential to Oakland and essential to us as journalists who wish to emphasize the point that you can kill the messenger, but the message is still going to get through. Based on this alone, I believe this will be the most important work any of us have ever done and ever will do.” Let me add, as an occasional critic of Dean Singleton, owner of the Media News Group, that this project may be the most important work that he or any of his papers have ever done or will do. I congratulate him for allowing his troops to plow forward on a tough story that everyone involved knows how high the stakes are.

The coalition’s message is profound and dramatic: you can’t kill a journalist, in the Bay Area, in California, in the United States, and get away with it. Because the best reporters and editors and news organizations in the area are going to go after you and see that the story is told and justice is done.

When journalist Chauncey Wendell Bailey Jr. was murdered Aug. 2, questions arose as to who could have committed such an act, in broad daylight, and what could have motivated the killing. Shortly after the slaying, police arrested Your Black Muslim Bakery handyman Devaughndre Broussard, 19, and charged him with the crime. But deep questions remain, starting with who really called the shots in the killing — and what they were trying to cover up.

In an effort to pick up where Bailey left off, a rare coalition of media rivals and scholastic colleagues — more than two dozen reporters, photographers, and editors from print, broadcast, and electronic media — have formed the Chauncey Bailey Project, an investigative team that will continue and expand on the reporting Bailey was pursuing at the time of his death.

"We as an industry cannot stand for a member of the press to be gunned down in the course of doing his job. That’s a threat to democracy; that’s a threat to journalism," said Dori J. Maynard, president and chief executive officer of the Robert C. Maynard Institute for Journalism Education.

Although several local media outlets have reported on the circumstances that may have led to Bailey’s death and his connection to Your Black Muslim Bakery, this project will delve deeper into his investigative work prior to his death.

The project promises to be the largest communal journalistic endeavor since the Arizona Project was formed 31 years ago in the aftermath of the murder of Arizona Republic investigative reporter Don Bolles. The Guardian is committing the efforts of award-winning reporter G.W. Schulz and other resources to the project. Our media partners include the Bay Area Black Journalists Association, Bay Area News Group (including the Oakland Tribune, Contra Costa Times, and San Jose Mercury News), Center for Investigative Reporting, KGO-AM, KQED Public Radio, KTVU-TV, KPIX-TV, Maynard Institute for Journalism Education, National Association of Black Journalists, New America Media, New Voices in Independent Journalism, UC Berkeley Graduate School of Journalism, San Francisco State University Journalism Department, San Jose State University Journalism Department, and Society of Professional Journalists (Northern California Chapter).

SONIC REDUCER Do you believe in magic? Or voodoo? Or the links between ecstasy and long-term memory loss? If you’re a firm believer in the last, then you probably can’t recall the good ole days of garage rock — and no, I’m not talking about ’60s snarlers like the Seeds, the Standells, and the Chocolate Watchband nor ’80s revivalists like the Fleshtones, the Chesterfield Kings, and Holly Golightly. I’m searching the motley gray matter for that fuzzed-out, lo-fi, house-rockin’ turn-of-the-century blast from the early ’00s past, the one that teetered forth in the crusty, musty, mop-topped form of the Hives, the Von Bondies, the Vines, the Dirtbombs, the Strokes, the Detroit Cobras, the White Stripes, the Makers, the Datsuns, et al. In ’02 you were crap on a cracker if you didn’t come with the thes and the esses and the three chords and the loud, plowed, and way-too-gristly grizzly rock ‘n’ roll.

So where did all the good times go, troglodytes? The initial ’60s American garage rock siege was hopped up on the rawboned, blues-indebted British Invaders. But this time around did the bands simply get bored of the same few chords? Or weary of the uniforms? Was it simply another historical hiccup in musical trend cycles, a brief burst of energy fed by pink-slipped creatives and millennial joie de vivre?

Still, longtime listeners know garage rock never quite stops. The ahistorical trendoids who leaped aboard the bandwagon — who didn’t know your Kingsmen from your Chesterfield Kings or "Louie Louie" from "Talk Talk" — may have moved on to the next flavor of the weak. But snotty rock springs eternal — like mucus. Among the main remaining perpetrators today are those bone-deep bad boys with one foot in rock’s past and another in the future the Black Lips, the kid bros of all of those ’00s garage third wavers, who arrived kitted out with a tumescent, prepubescent sense of humor, a hot and sweaty live show, innumerable 7-inches, and now four full-lengths. I remember taking a listen to the Black Lips’ first self-titled Bomp! CD four years ago and finding that it rose above the pile of garage-bound by-the-bookers like so much toxic, nonnutritious, black-flecked, punky foam.

The Atlanta group’s latest CD, Good Bad Not Evil (Vice), finds them name-checking girl-group matresfamilias right up front — looking to a line from the Shangri-Las’ "Give Him a Great Big Kiss" with the album title — while still plying their grimy tricks: they sing the praises of "Magic City titties," strike pseudoreverent poses with "How Do You Tell the Child That Someone Has Died," and invoke the spirit of Professor Longhair and the 13th Floor Elevators while slamming the "ruthless old bag" that swept through N’awlins on "O Katrina!" The epicenter of Good Bad Not Evil might be "Veni Vidi Vici," punctuated by creepy slaps and skin-crawling licks as vocalist-guitarist Cole Alexander mocks, "Mirror, mirror on the wall / Who’s the greatest of them all / My man Muhammad, Boy Jesus too / ‘Cause I came, I saw / I conquered all / All y’all, all y’all, all y’all / People look towards Mecca’s way / Sistine Chapel people pray / It don’t matter what you do / Holy World War will come for you." Call it flower punk, as the Black Lips are wont to do, or conscious garage rock or backpacker bop, but it sounds like the scamps are reaching past the retro toward some real issues these days.

Of course, the Black Lips won’t spill the goods. Not that they can, when talking to Alexander, 25, turns out to be an exercise in total frustration. On a mobile and on the move through Indianapolis with the rest of the combo, the vocalist kept dropping out — or hanging up — betwixt juicy tidbits on dating Osama bin Laden’s niece Wafah Dufour ("We discussed making some instrumental tracks and hung out. She was really nice and pretty and cool, so we’ll just see how it goes") and giving equal Lip to Israel and Palestine, performance-wise ("These things make it seem like we’re more politically involved, but we just like to have fun. None of the Palestinians were able to come to see us, so we played in front of a mosque with just guitars. There are posters everywhere of suicide bombers’ faces — those guys are like rock stars there. But the kids loved it and were really intrigued that a punk band would play for them"). Still, after spending more time yammering to dead air than engaging with the vocalist — and finding "Veni Vidi Vici" inexplicably skipping on my copy of the new LP — I finally understood: these kids were born under a bad sign, and how. Good bad, though, not evil. *

The Oakland City Council made an unprecedented move toward environmental justice Oct. 2 by appointing Margaret Gordon to the Oakland Port Commission. It is the first time that a community activist, rather than a businessperson or a political insider, has been named to that powerful body.

The action was roughly equivalent to naming Michael Moore to the board of the National Rifle Association. For years Gordon has led an effort to hold the port accountable for poisoning the air in her neighborhood, where the American Lung Association has found that one in every five children suffers from asthma.

Gordon’s nomination, along with that of International Brotherhood of Electrical Workers business manager Victor Uno, signals a clear call for reform from Mayor Ron Dellums, who issued a prepared statement commending the council "for recognizing the importance of appointing individuals who are capable of understanding both the economic and the environmental impact of the various Port facilities."

Gordon’s appointment almost didn’t happen. Dellums withdrew his two nominees from consideration at the council’s July 17 meeting after it became clear that Gordon would have trouble winning the necessary votes. Since that time Dellums has lobbied hard for their confirmation and finally saw Uno approved unanimously and Gordon on a 7–1 vote (Councilmember Desley Brooks voted no).

"The mayor has emphatically stood behind Victor and I," Gordon told the Guardian. "He has a vision for the port. He wants it to be efficient, to grow, but not to cost people’s health. The port is supposed to make money, but it’s not supposed to make people sick."

The appointments come at a critical time. The port is now drafting a long-overdue clean-air plan, while state regulators are developing stringent clean-air requirements for ports. The Coalition for Clean and Safe Ports, a national consortium of labor and environmental activists, is also advancing a proposal at Oakland and other US ports that would radically change the way port trucking is structured.

The two appointees, who begin serving immediately, will play key roles in shaping the port’s proposal. The Port Commission could vote on a final comprehensive clean-air plan as early as December. Doug Bloch, coordinator for the Coalition for Clean and Safe Ports, told us he is "cautiously optimistic" that the seven-member Port Commission will approve his group’s proposal. "We have two votes now," he said.

The coalition seeks to clean the air by improving the sweatshoplike working conditions of port truckers, who often drive the cheapest, most polluting trucks. Its plan calls on the port to require trucking companies to maintain vehicles and hire truckers as employees. The California Trucking Association and the Pacific Maritime Shipping Association have aggressively opposed the plan, which could herald the return of the Teamsters Union. Since they are classified as independent contractors, it is illegal for truckers to join a union. As employees, they would receive benefits and have the option to organize (see "Importing Injustice," 7/18/07).

Uno told us, "Truckers becoming employees is definitely part of the solution. It is clearly one of the ways to address this issue." Asked in July if he thought a proposal could succeed without requiring trucking companies to hire truckers as employees, he said, "I do not see how that is possible, given the lack of regulations in the trucking industry. It’s a dog-eat-dog world among independent truckers."

Gordon told us she is in favor of any plan that improves air quality and truckers’ lives but is not convinced that making them employees is the only way. "All I’m worried about is that small businesses, unions, and community health organizations can work together," she said. "We have to be unified in resolving these issues."

Ray King, general manager of marine operations at the port, told the Guardian that a tentative outline of the port’s plan will be posted to its Web site in the coming weeks, after which it will accept public comments for 30 days.

City Council president Ignacio de la Fuente had been Gordon’s key opposition in July. He told the Oakland Tribune that an appointee was needed "who understands [the port’s] need to be competitive, to be efficient, and to grow. The fact is, we have the responsibility for balance." But at the Oct. 2 meeting, he called Gordon "a great asset" and said her appointment will lead to "the creation of a balanced Port Commission."

For the past year and half Gordon has sat on the cabinet-level working group appointed by Gov. Arnold Schwarzenegger that developed allocation guidelines and detailed clean-air requirements for more than $3 billion in Proposition 1B bond funds approved by California voters last year for port expansion and environmental mitigation projects. Port spokesperson Libby Schaaf told the Guardian that its success in securing these funds will play a central role in its expansion plans.

Councilmember Brooks, the sole vote against Gordon, worries that the plan could hurt the port’s fiscal viability. "This is the fourth-largest port in the US. This is the economic engine of the region. We need to ensure that we move in a direction where it will continue to grow. The port is getting ready to see some very tight times," she said at the meeting. "I told the mayor I hope he proves me wrong with this appointment."

Jack Davis, 1940-2007

Jack Davis was a relentless and often unheralded advocate for underfunded, outflanked, and ignored artists, community groups, social movements, and others shunted aside by mainstream venues and the art establishment.

Davis died Sept. 23 at Henry Mayo Newhall Memorial Hospital in Valencia from injuries sustained in a car accident. He was born Nov. 16, 1940, in Phoenix, Ariz., and came to California to attend the University of Santa Clara and San Francisco State University in the late 1950s and ’60s. He studied theater arts in Northern California, then was one of the directors and founding actors of the South Coast Repertory in Orange County. He married Judith Watson and returned to San Francisco in 1968.

Well known in the underground art world that he helped pioneer, Davis was a pivotal figure in the growth and public awareness of hundreds of uniquely San Francisco creative projects. For nearly 20 years he was director of the SomArts Cultural Center, which provides classrooms and work space for community-based programs and theater and gallery access to nascent and established artists.

But his contributions went far beyond SomArts. He and Rene Yáñez helped found CELLspace, a unique community and cultural center in the Mission. Davis was an early supporter of Burning Man and hosted its parties, meetings, and large-scale events at SomArts. He also provided technical support and counsel for the Day of the Dead and other San Francisco street events.

Under his leadership SomArts hosted myriad edgy and unconventional troupes and shows. Davis hosted early events by Survival Research Laboratories, which essentially created the machine-and-fire art scene that is now renowned around the world. Davis would often need to run interference with the Fire Department and other authorities who were concerned about the SRL’s seemingly dangerous experimentation.

Davis assisted in the evolution of that scene at every step, recently providing support services so the Flaming Lotus Girls could bring their massive Serpent Mother project to the "Robodock" festival in Amsterdam last month. Other SomArts projects Davis facilitated include the offbeat Naughty Santa’s Black Market, the Queer Arts Festival, Balinese shadow theater, DadaFest, the SF Electronic Music Festival, and the SF Indie Fest.

Davis also helped win national recognition for the alt-art movement by working with Eric Val Reuther, a panelist for and consultant to the National Endowment for the Arts, to bring many worthwhile (and underfunded) groups to the attention of the NEA. Davis also cofounded the Neighborhood Arts Program National Organizing Committee and helped set up its West Coast office in San Francisco.

Among the community-based groups Davis helped establish were the Bayview Opera House, the Native American Cultural Center, the Mission Cultural Center, and the Western Addition Cultural Center. He helped create a theater at Lone Mountain College, was director of Intersection for the Arts, and organized the San Francisco Blues Festival with Tom Mazzolini. In the summer Davis and his son Hayden and their friend Ernie Rivera built stages and performance areas for street fairs and other events.

As director of Intersection for the Arts, Davis hosted many unknown performers who went on to acclaim in the larger world of theater, including Diane di Prima, Whoopi Goldberg, Bob Carroll, Ntozake Shange, Bill Irwin, Paul Dresher, and Rinde Eckert. Other groups Davis supported include the SF Mime Troupe, the Farm, the Pickle Family Circus, Make a Circus, and Dance Mission. Davis and George Coates were cofounders in the 1980s of the San Francisco International Theater Festival, which brought the early work of Spaulding Grey and others to the public’s attention.

"Jack was unflappable — nothing threw him," Coates once told me.

Davis lived on a houseboat — one of three he built over the years — with his daughter, Sarah, and his son-in-law, Shawn Lytle, in Mission Creek in San Francisco’s China Basin. As the longtime president of the Mission Creek Harbor Association, Davis fought developers and bureaucrats in a never-ending battle for the right of an organic, human-scale community to simply exist in this city. Many a weekend afternoon Davis could be found tinkering away on his or perhaps one of his neighbors’ boats. Due in great part to Davis’s efforts, Mission Creek remains one of San Francisco’s garden spots, even while surrounded by new development.

Davis was seen as a Buddha-like figure in the often-fractious world of community arts and politics. He was a bear of a man who exuded a preternatural calm. Composer, producer, and photographer Doug McKechnie noted once after a particularly rough MCHA meeting, "I was in awe of his ability to get things done with such grace, style, and simplicity. He could come into a crowd of bickering people, and they listened."

Davis was also instrumental in rejuvenating the Bay View Boat Club. "One day in 1984, Jack called me up and said, ‘Meet me at the Bay View Boat Club,’>" McKechnie said. "He showed me around the place and said, ‘I think this place has tremendous potential. Let’s join and see what we can do.’ Jack talked the club into having a special, one-year membership drive that allowed people who didn’t have a boat to join. We called everyone we knew, and before you could say ‘Bottle of beer’ the club had 200 new members, all of whom eventually got boats. Jack was elected commodore two years later and set the model for what is still one of the most astonishing, real, funky places in the world."

Davis is survived by his wife, Noriko Tanaka; ex-wife, Judith Davis; daughter, Sarah Coseby Davis; son-in-law, Shawn Lytle; son Arthur Fumiko Davis; daughter-in-law, Tesa Davis; grandchildren, Jordan Alexander Davis, Jacquelyn Rae Davis, and Olivia Davis Lytle; brother, Bill Davis; sister, Lynn Davis; and cousins, Patty Costello, Martha de la Cruz, and Amy de la Cruz. Jack’s mother, Jean Davis Mueller, age 94, resides in Scottsdale, Ariz. His son Hayden Carlos Davis died in 1999.

A celebration of Jack Davis’s life will be held Nov. 18 at the SomArts Cultural Center, 934 Brannan, SF, from 3 to 8 p.m. The family is establishing a scholarship fund for Arthur Davis. For information visit www.somarts.org.

The price of the sweeps

The number of homeless individuals slapped with quality-of-life citations and the cost to the city of processing those citations reached new highs in the past 14 months, according to a study released by Religious Witness with Homeless People. San Francisco taxpayers have paid more than $2 million for more than 15,000 citations issued to people for crimes committed because they have no place to live.

"The quality-of-life citation … begins an extremely expensive process," said Michael Bien, a lawyer on the steering committee of Religious Witness, an interfaith activist group started in 1993 by Sister Bernie Galvin.

The study, released at an Oct. 4 press conference, was based on documents provided by various city departments. The authors collated the costs from the initial ticket issued by a cop through the entire court process, including the new price of prosecution by the District Attorney’s Office (see "The Crime of Being Homeless," 10/3/07).

The results are an update of a similar survey conducted last year (see "Homeless Disconnect," 9/5/06). Collectively, the two studies found that a total of 46,684 citations have been issued to homeless people, at a cost of more than $7.8 million, since Mayor Gavin Newsom took office.

But the mayor might not want you to know that. While Religious Witness was unveiling the study at a press conference in the South Light Court of City Hall, the mayor was hosting a simultaneous event about his heavily promoted Care Not Cash program, which provides homeless people with services and housing instead of the money they once received through the County Adult Assistance Program.

"What really bothers me," Sup. Ross Mirkarimi told the crowd gathered to hear Religious Witness, "is that we learn at the last minute that Mayor Newsom decides to have a press conference at the exact same time. To me, that couldn’t be more base and exhibitive of bad form … to try and upstage a press conference like this." He said the mayor’s administration should be working with organizations like Religious Witness, not competing against them.

NEWSOM WON’T MEET


Galvin expressed dismay that the mayor chose not to attend, on top of scheduling a competing press conference on the issue of homelessness. "We’ve never had a press conference where we didn’t have full press coverage," Galvin said.

"We’ve been trying to meet with Mayor Newsom since the day he took office," Bien said. "He hasn’t even given us the dignity of a response."

Newsom’s press secretary, Nathan Ballard, said he knew nothing about the event until he returned from his boss’s fete at the Pierre Hotel, a single-room-occupancy hotel on Jones Street that houses some Care Not Cash recipients. He denied any intention to detract attention from Religious Witness’s study. "I chose to do this a couple of weeks ago. There’s no deep, dark conspiracy," Ballard said. The day was chosen to announce that Care Not Cash had "reached a significant milestone of housing over 2,000 formerly homeless individuals," according to a press release.

Actually, the Care Not Cash program exceeded the 2,000 mark in August, according to statistics posted on the mayor’s Web site.

This is not the first time the mayor has scheduled a competing press conference. In June, on the same day the Board of Supervisors passed the city’s Community Choice Aggregation plan for more city-owned renewable energy, the mayor announced a new partnership with Pacific Gas and Electric Co., to study tidal power (see "Turning the Tides," 6/27/07).

Religious Witness chose Oct. 4 to release the study results because it’s the Feast of St. Francis, a day celebrating the city’s patron saint, "a man known to have enormous compassion," Father Louie Vitale explained. "Does the mayor have compassion fatigue?" he wondered aloud.

The decisions about where a city spends money speak volumes about its values. "Every budget is a moral document," said John Fitzgerald, who enumerated many other uses to which the $2 million could have gone, from placing 1,028 people in three-month residential drug treatment to five new drop-in mental health clinics, 157 new caseworkers, or 10,230 preventable evictions.

THE NEW MATRIX


Sup. Chris Daly, who attended but did not sponsor the Religious Witness press conference, said, "Not only is the use of police to target homeless people uncompassionate and inhumane, but it’s also ineffective." He recalled the first Religious Witness press conference, which denounced then-mayor Frank Jordan’s Matrix program, which teamed police officers with social workers to remove homeless people from Union Square and later Golden Gate Park. That program was deemed a failure because it criminalized homeless people and alienated them from helpful services by teaming outreach workers with law enforcement.

"We’re repeating a policy that we know is a failure," Daly said. "It’s a complete lack of compassion."

Recently Daly made public a memo he obtained from the mayor’s office through a public records request. The document outlined a new "downtown outreach plan," similar in sound and structure to Jordan’s Matrix. In a Sept. 28 Weekly Report to Newsom’s chief of staff, Phil Ginsburg, deputy chief of staff Julian Potter wrote, "The pilot program includes three separate teams of officers and social service staff that work a 15-block area" in two separate shifts patrolling the SoMa district. "In each of the three teams an officer will work in tandem with two social service representatives. Any person committing a crime (littering, encampment, trespassing, urinating, defecating, dumping, blocking sidewalk, intoxication, etc.) will be asked to cease the behavior and enter into services. If the individual resists services the officer will issue a citation."

Though it’s reminiscent of the approach that Jordan advocated, both the Operation Outreach team, made of police officers who typically interface with homeless people, and the Homeless Outreach Team, operated by the Department of Human Services, have denied they would accept the approach as Potter penned it.

"I have to be very emphatic," said Dr. Rajesh Parekh, director of HOT. "We are not going to be teamed up with police officers." Though police officers often refer HOT to specific people, he said recent news reports are inaccurate and "in the interest of our clients we’ve never done shoulder-to-shoulder work."

Lt. David Lazar, who heads the San Francisco Police Department’s Operation Outreach, agreed that his officers won’t walk in lockstep with the doctors and social workers who are offering services. But the line can get a little fuzzy: "We’re there at the same time, but we’re not necessarily together," he said. "We’re separate in our approach."

"Basically what the memo is proposing is illegally arresting people," Jenny Friedenbach, executive director of the Coalition on Homelessness, told us.

Under state law, people can’t be taken into custody for infractions like urination and littering. But camping illegally can be considered a misdemeanor, and a citation could eventually lead to an arrest and a jury trial. Prosecuting and imprisoning people is far more expensive than providing shelter.

While some see the coupling of enforcement with services as a way to encourage more people to get help, others contend it’s not a simple equation.

"I think some people are not always able to say yes the first time we do outreach with them," Parekh said. "I’m hoping that as time goes on we’ll be able to persuade them. It’s an ongoing process. It’s not a one-time thing." He said more than half of the help offered is accepted in some form, but it can take as many as 20 attempts to win over what amounts to a small number of people who require persuasion.

Representatives from the Coalition on Homelessness on Oct. 4 witnessed the first of the SoMa sweeps, or "displacements," as they’re more kindly called, and confirmed that the cops and service providers had some distance between them.

"That’s what they did during the first month of Matrix," Daly said to the Guardian. "That will change over time."

In the meantime, the supervisor has reintroduced a $5 million allocation for supportive housing for homeless people that was passed by the board last spring but defunded by Newsom.

Green City: Plugging into what’s next

GREEN CITY Hybrid cars — those that run on a combination of gasoline and electricity — are all the rage among drivers looking to go green. But imagine a car that could drive 100 miles on one gallon of gas. That’s what a hybrid could get if converted into a plug-in version, something Bay Area residents are starting to do themselves, filling a void left by the auto industry.

The California Car Initiative (a.k.a. CalCars) is on a mission to make plug-in hybrid electric vehicles widely available. In collaboration with organizations like Plug-In Partners and Plug-In Bay Area, CalCars is on a mission to persuade carmakers to mass-produce plug-in hybrid vehicles. The technology already exists, allowing our cars to be much more fuel efficient.

The first prototype PHEV was created by CalCars in 2004. This Palo Alto nonprofit converted a Toyota Prius into a Prius+, a plug-in hybrid able to travel more than 100 miles using only one gallon of fuel.

A PHEV is essentially a hybrid that has additional battery capacity and can be recharged from a household 120-volt electrical outlet. CalCars promotional materials explain the way a plug-in hybrid works: "It’s like having a second fuel tank that you always use first — only you fill up at home, from a regular outlet, at an equivalent cost of under $1 per gallon."

"Conversions are a strategy, not an end in themselves," Felix Kramer, CalCars founder, told the Guardian. "The game is all about getting hundreds of thousands of PHEVs on the road from carmakers."

Toyota recently announced it will be testing PHEV prototypes this fall in Japan, Europe, and the United States. General Motors has also announced it is working on a plug-in hybrid called the Volt, to be publicly released in 2010. A handful of other car companies have expressed their intention to produce PHEVs but haven’t given release dates.

Public support by municipalities — including San Francisco, which passed a resolution to support PHEVs in 2006 — is also putting pressure on car manufacturers. Until plug-in hybrids are put on the market, PHEV advocates are keeping the pressure on. CalCars has posted its Prius conversion method on EAA-PHEV.org, a wiki dedicated to discussing and documenting plug-in hybrid conversions.

The step-by-step instructions are continually being improved, part of the beauty of open-source material. Only 2004 or newer Priuses are capable of being converted with this process. And for now, only do-it-yourselfers who are "comfortable around high-voltage batteries and automotive workshops" should attempt to convert their cars.

One such person is Daniel Sherwood, an electrical engineer living in Berkeley. He is in the process of converting his Prius into a plug-in hybrid using CalCars’ open-source instructions.

"In a regular hybrid car, I couldn’t go two blocks without using gas," he told us. "With this conversion, I’ll be able to drive about 12 miles using only electricity." When he needs to drive longer distances or needs to drive faster than the 35 miles per hour allowed by the battery-only power, the gas engine will kick in.

Darren Overby, who operates a hostel in San Francisco (and has previously worked as an electrical technician), is also in the process of converting his Prius. He is thrilled at the prospect of owning a vehicle that relies mostly on electricity. "Electricity is the only alternative fuel that is both sustainable and scalable. It could actually grow to meet the needs of everyone in the country. "

Plug-In Supply of Petaluma is also creating conversion kits that have all of the necessary components already assembled. Everybody agrees that the conversion process isn’t cheap. But the price of oil — including greenhouse gas emissions and war — makes plug-ins an increasingly attractive option, at least until the car companies get in gear.

"Had it not been for the grassroots effort," Sherwood said, "backyard conversions wouldn’t be possible. Car companies wouldn’t even be thinking about making plug-in hybrids." But they’re thinking about it now.

Stop the homeless sweeps

EDITORIAL Sister Bernie Galvin and Religious Witness with Homeless People held a press conference Oct. 4 to release some remarkable data: since Mayor Gavin Newsom took office, San Francisco has issued 46,684 citations to homeless people, mostly for what are known as quality-of-life crimes. That’s cost the taxpayers $7.8 million.

Unfortunately, almost no news media showed up — the mayor, it turns out, somehow scheduled his press conference on homelessness at exactly the same time. As Amanda Witherell reports on page 15, Newsom’s staff say it’s all a coincidence — but it reflects how this administration is increasingly treating homeless issues.

Newsom, with the assistance of District Attorney Kamala Harris, is shifting the city back to a model that treats homelessness and poverty as crimes. But years of evidence prove that approach doesn’t work.

Newsom’s plan, outlined in a memo that Sup. Chris Daly made public last week, involves sending a team of social service and outreach workers through the Tenderloin with police officers. Now the cops and the social workers are saying they won’t patrol together, but the message and the impact are the same: people who commit the sorts of offenses that are almost inevitable when you don’t have a place to live — like sleeping on the streets and panhandling — will increasingly be dragged into the criminal justice system.

Frank Jordan, a former police chief, tried that when he was mayor in the early 1990s; he called the program Matrix, and it was an utter failure. The reason is obvious: most homeless people can’t pay the fines for these violations. So either the citation process is a waste of everyone’s time or, if the city pursues the nonpayment and piles on more and more citations, it winds up creating a criminal record for someone who already is going to have trouble finding work. The promise of services implied by the social workers’ involvement in Newsom’s plan means nothing if services aren’t there — and the city still can’t offer, say, substance-abuse treatment on demand or enough housing for all of the people who need it.

Yet despite all the evidence, Harris has now assigned a full-time staffer to do nothing but prosecute these low-level offenses. She and Newsom both say they want to help people use services — but the only service the DA’s Office offers to homeless people who wind up in court is a handout, a single-page list of referrals.

San Francisco has been down this road so many times before that it’s infuriating. Criminalizing homeless people is not only wrong; it’s expensive, inefficient, foolish, and morally offensive. It also clogs the courts and takes the cops even further away from working on serious crimes.

Daly says he’s going to reintroduce his measure allocating an additional $5 million for housing for homeless people. That’s a good move, of course. But the supervisors ought to think about something else: if Harris, Newsom, and the cops want to persist in counterproductive and cruel homeless sweeps, perhaps the supervisors should move to cut funding to those departments by a total of, say, $7.8 million. 2
