Bakery driver still on the lam?

Since a trio of shotgun blasts killed Oakland Post editor Chauncey Bailey on Aug. 2, police and prosecutors have charged only one man with the crime: 20-year-old Devaunghndre Broussard, a handyman at Your Black Muslim Bakery, who is expected to be arraigned this morning.

But Oakland police records raise questions whether a second man, a 21-year-old former San Francisco resident with an extensive and violent criminal history, may have played a role in the journalist’s slaying.
That man, Antoine Mackey, who lived with Broussard and worked at the bakery, remains free. It’s unclear whether police are actively seeking to question him about possible connections to the crime.
Reached on a cell phone with an Atlanta area code earlier this week, Mackey denied any involvement in Bailey’s death.

But a bakery associate, Rigoberto Magana, told detectives that on the morning of theslaying, Mackey drove away from the bakery in a white Dodge Caravan belonging to Magana, according to handwritten police interview notes.

The vehicle in question figures prominently in the crime: Broussard later told homicide detectives he’d used the van to get to and from the scene of Bailey’s killing near 14th and Alice streets in downtown Oakland, and witnesses reported seeing a white van in the vicinity.

One witness said the gunman got in on the passenger side of an older Dodge Caravan shortly before shooting; another saw the assailant flee the crime scene in a waiting white van, police incident reports state.

When homicide detectives questioned Magana, he told them Mackey drove the van away from the bakery’s San Pablo Avenue headquarters at between 5:30 and 6 a.m., returning it to the bakery between 7:30 and 7:35 a.m. with a damaged rearview mirror. Bailey was shot at 7:25 a.m., according to police reports.

Magana, who was living at the bakery, identified Antoine Mackey immediately when shown Mackey’s photograph as the person who drove away in his van and later returned it, the police notes state.

Bakery leader Yusuf Bey IV and Broussard gave police accounts of driving around the night before the killing with Mackey and also met him at the bakery immediately after the shooting and drove to the scene together, according to interview transcripts obtained by the Chauncey Bailey Project.

Broussard, who, like Mackey was raised in San Francisco, told police he shot Bailey three times because the journalist was working on stories about the bakery’s financial woes. He later recanted.

Days after Broussard’s Aug. 3 confession, Oakland police told the media their probe was ongoing and suggested Broussard likely had help. “We don’t believe he acted on his own,” Assistant Chief Howard Jordan said days after Bailey died.

Oakland Police Chief Wayne Tucker did not return telephone calls Wednesday and Thursday to answer questions about Mackey. In earlier interviews, Tucker and other officers refused to discuss him.
Officer Roland Holgren, a department spokesman, said Thursday he couldn’t answer any questions about the Bailey case.

Broussard’s defense attorney said he believes Mackey was involved in Bailey’s killing, and police may have detained him when they raided the bakery compound Aug. 3 but allowed him to go free.

Soon after, Mackey became a fugitive.

He failed to appear for a criminal hearing in San Francisco on Aug. 17, and a warrant was issued for his arrest.
He disappeared, attorney LaRue Grim said this week. “We are hoping he will be picked up sometime in the future.”
Grim said he believes Mackey was involved. “He drove the van. Broussard is very reluctant to point the finger at anyone but I think he will be willing to do so at trial. If he does, he can implicate Mackey and Yusef Bey and couple of others.”

Bey, who is jailed for unrelated offenses, has denied any involvement in the slaying.
In addition to the revelations about the van, a review of police investigative documents by the Chauncey Bailey Project shows:

* In a taped jailhouse telephone conversation with a man identified only as “unc,” the man asked Broussard “what they do with Mackey?” “Mackey got out,” Broussard replied, an apparent reference to police possibly detaining Mackey and releasing him.

* Broussard told police he smoked a cigar laced with cocaine “when we were driving over there” to the corner where Bailey was ambushed. According to the transcript of the recorded portion of the interview, the homicide detective interviewing him, Sgt. Derwin Longmire, didn’t ask Broussard who he meant by “we.”

* Under questioning by Longmire, Broussard said he, Mackey and Bey IV drove past Bailey’s apartment near Lake Merritt the night before the slaying.

* Bey IV told police Mackey and Broussard drove with him to the scene of Bailey’s shooting shortly after it happened, and then went to Lake Merritt, where Bey IV claimed Broussard confessed to him he was the gunman.

* In interviews with detectives, Bey IV identified Mackey as a member of his security team.
Contacted Tuesday night, Mackey said he had nothing to do with Bailey’s shooting.

“I don’t know anything about that. I’d never even consider talking about anything like that,” he said, adding he knew Broussard, whom he described as “the dude from the Muslim bakery.”

They’re still groping away at that mirage in the distance where we all get to know what actually happened on 9/11, who was behind it, and how to claim the tragedy for political means in order to replace one lame duck for another in that most outmoded of positions, “American president”. The Boston Tea Party is slated to become another terribly misused reference to successful protest in this, its 234th anniversary, as activists try to gather angry Americans not sold on the media’s representation of the World Trade Center bombings at both Bostonian and San Franciscan docks. Attendants are asked to dress in colonial attire—preferably from the late 18th Century (leave the pith helmet at home, Grandpa)—and to bring fifes and drums, presumably for their distracting novelty value.

“Proclamations” will be made denouncing such garbage as the 9/11 Commission Report, PATRIOT Act, Military Commissions Act, and just the broad, general notion of all-around tyranny. “Genuine” investigation, accountability and impeachment will be called for. The final act of protest will be a mass dumping of cardboard and bleached paper—a series of large, corny replicas of the actual published work being protested—into that precious natural resource: the San Francisco Bay. At least they could make ash of the boxes first, like they’re doing in Milwaukee, and in a slightly more tasteful and harmless move stick to dumping spent carbon instead.

Yes, let’s all wheel a bunch of junk effigies down to the bay and dump them in the water in a game of dress-up, all on the basis that errors can be found in each account given on the attacks, which isn’t exactly the most surprising turn of events since the trial in Rashomon.

Comcast’s secret war on file sharing

TECHSPLOITATION For the past several months, Comcast has been covertly sending commands to your computer that tell it to stop receiving information — especially if that information is coming to you via BitTorrent, Gnutella, or other file-sharing applications. In May disgruntled Comcast users started posting on message boards about how BitTorrent and Gnutella weren’t working for them anymore. So researchers at the Electronic Frontier Foundation, along with an AP investigative journalist, started running tests on the Comcast network, using software tools to examine what exactly Comcast was doing to BitTorrent.

What they found was disturbing. Without telling customers, Comcast had begun a secret program to send automatic reset commands to customers’ computers if they were using BitTorrent, Gnutella, or a few other programs. None of these programs are illegal. Moreover, Comcast had sold its services to customers without informing them that this popular Internet software wouldn’t work on its network. And Comcast is still doing it.

To make matters worse, the method the folks at Comcast are using to shut down file sharing is underhanded. They stop BitTorrent by injecting reset data packets into information streaming between two computers on the Comcast network. Then Comcast makes the reset packets appear to be from one of the computers using BitTorrent — not Comcast. So even if customers know to look for these reset packets, they’ll believe the problem comes from the computer they’re trying to share files with.

When the EFF and angry customers confronted Comcast about its sneaky system, the company claimed that it was merely "slowing down" certain programs. But as the EFF pointed out last week in a research paper on the topic, reset packets are designed only to shut down communication between two computers. If Comcast wanted to slow down BitTorrent, it could have used a common program called a traffic shaper, which can adjust data speeds.

Comcast spokesperson Charlie Douglas told the Guardian that "Comcast is delaying peer-to-peer applications but not blocking them." He added that there is "no other technical way to delay" these applications than the method the company has chosen.

Without further explanation from Comcast, one is left wondering why the company would engage in such outrageously anticonsumer behavior. One possibility is that it views BitTorrent as a competitor. BitTorrent has made deals with various Hollywood studios to distribute movies online, which is something Comcast cable does for television. So maybe Comcast is playing dirty so its customers will turn to cable TV for movies instead of getting them online via BitTorrent.

For people who don’t care about using BitTorrent, though, Comcast’s behavior is still a gesture of bad faith. The company is demonstrating quite plainly that it won’t hesitate to deny basic Internet services to its customers without warning, and without even acknowledging that it’s doing it. Today those services are for file sharing. But tomorrow they could be for sending e-mail that doesn’t use Comcast’s Web mail system.

I also think Comcast’s actions are a harbinger of what’s to come as Internet service providers get sucked into larger media companies with cable or content-making divisions. No laws guarantee network neutrality online, so Comcast is free to engage in network prejudice. The company can block any service it wants, especially if there’s a financial incentive. Certainly, consumers can choose to go with another Internet service provider, and I hope they do. But in the future, market competition may not be enough.

If Comcast blocks BitTorrent, then another company might welcome BitTorrent traffic but block my favorite game services. Internet service will become like cable TV, where getting the full range of channels is incredibly expensive. Except it will be worse, because the Internet is a far richer and more diverse place than cable TV. Selectively blocking the Internet is like selectively blocking expression itself.

The shooting death of football’s Sean Taylor was mangled by the Media

Fox News isn’t the only media outlet that lets the facts get in the way of a good story.

Last week the sports media throughout the nation stumbled over themselves painting a “Boyz n the Hood” story line behind last week’s tragic shooting death of pro football star Sean Taylor in south Florida.

The theory was that Taylor just couldn’t shake his ghettoized past.

It’s an idea that’s quickly becoming one of the most commonly used race-related clichés in sports. It’s a versatile stereotype too, adaptable to any African-American athlete who’s either a crime victim or is implicated in a violent crime.

While police in the early stages of their investigation said the attack did not appear to have any gangland connection, the media – columnists and sports talk show hosts who had minimal knowledge of Taylor’s life away from the gridiron – weren’t having any of it.

It was clearly a “home invasion” they said, orchestrated by a vindictive group of Taylor’s former running mates, who were kicked to the curb when Taylor inked a $19 million contract to play defensive back for the Washington Redskins.

Chavez snubs IAPA journalists in Venezuela

It was an amusing and telling moment in the history of freedom of the press:

I serve on the executive committee of the Inter American Press Association, and arrived in Venezuela on Nov. 17 as part of a mission to check on President Hugo Chávez’s accelerating crackdown on the news media. Chávez had a message waiting for our delegation.

It was a half-page advertisement from the Venezuelan National Assembly, in the big morning Caracas daily paper El Universal, reprinting a copy of a congressional resolution urging the executive branch to declare the IAPA non grata (not welcome) in Venezuela. (Scroll down to see a copy of the ad.)

That set the tone for our mission: The sponsor of the resolution refused to meet with the IAPA’s delegation. In fact, no member of the three branches of the Venezuelan government or the National Electoral Council was willing to meet with the IAPA.

However, Chávez, who was plastered all over the papers and television for his trip to Iran and France, did send us a Chavista group called Journalists for the Truth.

The president of the group told the IAPA mission that there was complete freedom of the press in Venezuela, then promptly went outside the room and told the waiting press that the IAPA had been “duped in good faith by the reports prepared by the ‘opposition’ Venezuela press.”

Gonzalo Marroquín, chairperson of the IAPA’s Committee on Freedom of the Press and Information, immediately retorted to the press that “it would seem that the journalists were at another meeting.”

In fact, the IAPA expressed “deep concern at the instability of press freedom in general and warned of the limited debate and public awareness surrounding planned constitutional reform and called on authorities to create an appropriate framework of guarantees and transparency for the Dec. 2 referendum,” according to its press release on its findings.

Earl Maucker, who led the mission as the IAPA’s president and editor of the South Florida Sun-Sentinel in Ft. Lauderdale, Fla., noted in a press conference that “the government’s unwillingness to talk about issues of press freedom and free speech, so essential to a democratic society, strengthens our belief that there is no real climate of respect, or the tolerance and political will to hold an open and comprehensive dialogue at a time when a major constitutional revision is under way.”

The mission met with members of the Venezuelan Press Bloc, a constitutional attorney, representatives of a human rights group, polling experts, the mayor of Chacao, the head of the National Press Workers Union, and other knowledgeable civilians. The mission and its final press conference were widely covered in the Venezuelan print and broadcast press. Marroquín, director of Diario Prensa Libre in Guatemala and a former television newscaster, was most eloquent in debating the IAPA’s findings on the government radio and television stations.

There were no violent incidents and no attempts to intimidate nor demonstrate against the IAPA mission. However, Chavez has made it difficult, if not impossible, for IAPA to hold its scheduled assembly next March in IAPA. Three different hotels in three different cities offered to host the convention, then mysteriously canceled their invitations.
Suddenly, two hotels said they did not have enough rooms, the third said it had it had rooms but could not provide meeting facilities. Even the J.W. Marriott Hotel that our mission was staying in asked us to hold our meetings and press conference in a nearby hotel.

Interestingly, after I posted a report on my blog, a self-described Venezuelan named Palomudo offered a comment describing the IAPA as a club of rich media owners.

“Look who owns the media in the USA and ask yourself what they did to convince you of their lies,” Palomudo wrote, echoing the Chávez line. “Remember Saddam and the weapons of mass destruction? … The media is your worse [sic] enemy and people like Bruce B. Brugmann are nothing more than media mercenaries pay [sic] to lie!!!”

Quite a statement, considering the Guardian is one of the strongest critics in the nation of media concentration and has consistently written about and criticized the mainstream media’s misreporting on Iraq. As an independent paper with a left-liberal approach, we’d be open to supporting some of Chávez’s economic policies of fighting multinational oil companies and redistributing wealth.

But we also believe that all governments — left, right, center, and otherwise — need a free and vigorous press and unfettered public debate. As long as Chávez refuses to accept those essential conditions, we happily stand with the non grata editors and publishers in the IAPA, and the courageous editors, publishers, media, students, and everyone else fighting Chavez for press freedom in Venezuela. WISH LIST My family of origin is so nuclear that on smoggy days a mushroom cloud can be seen above the suburb where my parents still reside. During the holidays we gather there to rehearse and stage the roles we will alternately perform and resist in the ensuing year. While Dad tracks holiday cards sent and received on an Excel spreadsheet, Mom dons a pair of felt antlers and holes up in the kitchen. As for me, I revert to fatigued, endless reading, as if by some cruel law of repetition I have returned to that sullen moment in junior high when my only friend suddenly became popular, leaving me with nobody but books as my companions. Without intervention, I might remain in this half-hypnotized state, rereading Flowers for Algernon until the world outside grows dim, like a dream I can barely remember. This year, however, I’m readying myself with an eclectic batch of new books, books that make me want to participate instead of turning into a listless blotch of angst. These titles provide critical frameworks for dissent, suggest avenues for engagement, and probe cultural blind spots — generating new aesthetic possibilities along the way.

I, for one, like to kick off the holiday season with a powerful dose of well-researched feminist analysis, supplied this year by Susan Faludi in The Terror Dream: Fear and Fantasy in Post-9/11 America (Metropolitan Books, 368 pages, $26). It’s akin to taking vitamins to ward off the winter cold that’s going around the office. I read some Faludi, I ask my brother to help out in the kitchen. Faludi argues that a highly gendered mythology reasserted its virulent hold over the national psyche (as writ large by the national media) in the wake of Sept. 11. Drawing from an abundance of sources, she parses out the myth: strong male heroes rescue helpless girls, feminism is dismissed as a frivolous and dangerous mistake, and cowboys and manly men rise again to keep the home soil safe. In debunking this overblown narrative, Faludi demonstrates that it doesn’t actually help those it valorizes, nor does its rehearsal expedite an increase in national security or political accountability.

Investigating the symbolic construction of identity and myth from the angle of art, Tisa Bryant’s Unexplained Presence (Leon Works Press, 167 pages, $15.95 paper) takes up "black presences in European literature, visual art, and film." Fusing criticism, film theory, and fiction with a keenly poetic ear, Bryant reenters cultural artifacts to open up these symbolically loaded but structurally silenced or backgrounded characters and motifs. Her stories trace the ways in which black subjectivity is distributed or denied within pictures and plots, between viewers and artworks and artists, and in acts of conversation and debate, of queer identification or refusal to see. What is most remarkable is how Bryant transforms these elisions into acts of imagination, restoring or reconfiguring partially glimpsed subjects via fleet and surprising sentences that traverse the distance between representation and meaning.

Renovating symbolic systems can be hard work, and nothing restores a fatigued body and mind like making changes to the physical infrastructure — such as sawing through your drainpipes to divert "barely used" household water from sewers to gray-water systems for gardening and washing clothes. Sexily linking the macro to the micro, the locally grown junta known as the Greywater Guerrillas has expanded its how-to know-how into Dam Nation: Dispatches from the Water Underground (Soft Skull Press, 416 pages, $19.95 paper), a collection of essays that examine the global plight of water misuse and attendant broad-scale ecological impacts. I don’t think it undermines the gravitas of the issue to mention that portions of the book are a sheer pleasure to read, especially when editors Cleo Woelfle-Erskine, July Oskar Cole, and Laura Allen (illustrations were supplied by Annie Danger) detail their efforts to "disengage from the water grid" by taking plumbing into their own hands.

What James Kochalka takes into his hands in American Elf Book Two: The Collected Sketch Book Diaries of James Kochalka (Top Shelf Comics, 192 pages, $19.95) is his life, tidbits of which he transforms into daily diary comics. Visually and verbally, Kochalka risks a silly, reckless sweetness — a sampling of titles includes "Romance of Life" and "Everything was fine until the old wakey wake." The strips are also a little bit perverted and weirdly honest, as Kochalka’s elf-eared stand-in catalogs a receding hairline, farty dairy hangovers, and arguments with his beloved and salty-mouthed wife. As the pages and days pile up, the effect is infectious, such that, while under the diaries’ spell, I began to sense secret fissures of creative potential and magic in the mundane flow of everyday life.

Isa Chandra Moskowitz, Terry Hope Romero, and the army of flavor lovers they run with have changed the landscape of vegan cooking. In Veganomicon: The Ultimate Vegan Cookbook (Marlowe and Co., 336 pages, $27.50), Moskowitz and Romero draw inspiration from a variety of international cuisines, without making any claims to authenticity. The resulting recipes (mole, saag, and lasagna, to name a few) are adventures in surprising flavor combinations. A helpful foreword details how to stock a vegan pantry, and tips offered alongside the easy-to-follow recipes instruct on where to find specialty items or how to organize your cooking tasks — advice that, as an unskilled, distractible cook, I found particularly useful. An appendix of menus ranges from rich party foods to low-fat and easy-to-prepare options.

Printed in large type, so it’s easy to read when splayed open next to a bicycle, the repair-manual portion of the illustrated Chainbreaker Bike Book: A Rough Guide to Bicycle Maintenance, by Shelley Lynn Jackson and Ethan Clark (Microcosm Publishing, 256 pages, $12), builds from the ground up. Starting with the ethics and rewards of skill sharing, it moves on to detail parts, tools, and instructions for system-by-system checkups and repairs. The book’s second half comprises reprinted issues of the Chainbreaker zine, originals of which were lost when zinester Jackson’s New Orleans home flooded after Katrina. The zines complement the how-to portions with a wider view of the bicycle’s cultural impact — e.g., the role of bikes in the women’s clothing revolution, the democratizing potential of this low-cost form of transportation. Note: the book hits shelves in February, but aspiring bike enthusiasts can order it now at www.microcosmpublishing.com.

And to come full circle … Sherman Alexie’s first young adult (and graphic) novel, The Absolutely True Diary of a Part-Time Indian (Little, Brown Young Readers, 240 pages, $16.99), reminds me that a return to YA reading can be the opposite of mind-numbing — when undertaken with a book that’s emotionally spring-loaded, linguistically gymnastic, and devastatingly funny in turns. Drawing from his experiences growing up, Alexie tells the story of Junior (a.k.a. Arnold True-Spirit Jr.), a comic-drawing Indian kid who leaves his reservation to attend an all-white high school. Between racism at school and conflict with friends on the reservation, Alexie nails the ups and downs of a young artist learning to navigate by his own radar, amid competing claims from family and a sometimes encouraging but often deviously indifferent world. Ellen Forney’s inspired illustrations channel Junior’s manic, tell-it-like-it-is sensibility and provide a visual anchor for Alexie’s loquacious narrator.

He hears a new world

"I was just on the Farne Islands, off the northeast coast of England, near where I live, and at this time of the year they are covered with Atlantic gray seals that have come to birth their pups," environmental sound recorder and musician Chris Watson explains, recounting his latest field trip over a shaky Skype connection. "There are whole communities of female seals that sing and have these beautiful haunting voices. It’s sort of this siren voice. You can imagine sailors being drawn to it from across the waves."

Watson has made a peripatetic and enviable career for himself as a sound technician for radio and television (he earned a British Academy of Film and Television Arts award for his work on the BBC’s The Sound of Birds), pursuing and recording the natural world’s siren calls. From the Rolls-Royce-like purr of a lounging cheetah to the deep groans of an Icelandic glacier following its inexorable 10,000-year-old course to the Atlantic or the literally visceral snap of vultures cracking through the rib bones of a zebra carcass, the sounds one hears on Watson’s solo releases (all on the Touch label) are a far cry from the ubiquitous whale song CDs that clog Amoeba Music’s new age bins. Stunning in their clarity, Watson’s recordings are often beautiful and at times frightening. But more often than not, despite their natural provenance, they are simply otherworldly.

"It never fails to astonish me, the connection between the wild sounds of animals and what we hear as music," Watson says, reflecting on our impulse to immediately draw aural associations. "These sounds have the power to connect straight to the imagination in the same way that a piece of music may evoke certain images." Watson’s first experiments with sourcing the "musical" from his surrounding environment were in early industrial groups such as Cabaret Voltaire and Clock DVA, whose gritty samples and martial rhythms held up an acoustic mirror to the grimness of life in Margaret Thatcher–era Britain.

Although urban Sheffield is worlds away from a cove in the Galápagos Islands or a Kenyan veldt, Watson’s MO has remained consistent even as his locations have become more exotic and the available technology has dramatically improved from the first tape recorder he received from his parents at age 11. "Even in Cabaret Voltaire, I was interested in taking sounds from the world and working with them, or not working with them — just letting them be," the musician says. "Gradually, I became more and more interested in the sounds I was hearing outside than the sounds I was hearing in the studio."

Watson’s latest full-length, last year’s Storm, is also perhaps his most musical — at least compositionally speaking. A carefully edited three-part suite of field recordings, Storm traces a series of particularly aggressive weather systems that hit the northeast of England and Scandinavia in 2000. Watson recorded the storm’s early rumblings — with the lonesome bellow of seals as accompaniment. Meanwhile, longtime collaborator B.J. Nilson — who has released his own subtly processed, environmentally sourced ambient recordings under the name Hazard — caught what Watson calls "its last breaths" as it descended into the Baltic Sea.

"We were really fortunate to have a sort of narrative already there for us to work with," Watson says. "Of course, we couldn’t record the storm as it was crossing over to Europe, so the middle track is a sort of conjecture of what it sounded like, a combination of [Nilson] and my recordings." The two have been experimenting with transutf8g the album into a live piece, a version of which will be presented, sans Nilson, as part of Watson’s performance at Recombinant Media Labs on Nov. 30.

Reflecting on past performances of the piece, Watson remarks that he is continually surprised by how audiences react: "It literally has a powerful, moving effect on people. People have said to me that they put their coats back on because they were cold or found themselves shivering." Certainly, many more of us have heard if not experienced a powerful storm than could identify a recording of or have witnessed firsthand, say, giant sea turtles mating.

I jokingly ask Watson if he has ever visited the Tonga Room, the famed Polynesian-themed bar in the basement of the Fairmont Hotel, in which a tropical storm lets loose at 20-minute intervals over an indoor grotto. He laughs at the idea of the place and says that, regrettably, he hasn’t been. "But wouldn’t that be an amazing venue in which to perform Storm?" he suggests excitedly. The Fairmont’s guests would never know what hit them.

The proposed Central Subway project has arrived at a critical point in its planning stage, with the public comment period for its environmental documents coming to a close Dec. 10 after a series of recent workshops and meetings.

Proponents see the project as an important next stage of the Third Street Light Rail Project and a vital link to Chinatown, which was made less accessible when the Embarcadero Freeway was torn down. But even some transit advocates question whether the project, with a price tag of $1.2–$1.7 billion, has enough bang for the buck to be worth it.

The Central Subway would realize the San Francisco Municipal Transportation Agency’s long-standing vision for a subway system that links to the northeast sector of the city, alleviates traffic problems, and improves connections with BART and Caltrain.

This phase of the project, which proposes to connect the South of Market area to Chinatown by underground rail by 2016, has received the fiscal green light — $1.2 billion in state and federal funding is already pledged.

Board of Supervisors president Aaron Peskin, whose District 3 includes Chinatown, called the Central Subway "a very good and wise investment in San Francisco.

"Any investment in public transportation is a good thing," he added. "Is it expensive? Yes. But so were" many other transit projects.

Rose Pak of the Chinese Chamber of Commerce, an influential force in San Francisco politics, insists that the Central Subway project is imperative to the Chinatown community.

"It’s long overdue," she told the Guardian. "Over 70 percent of our people rely exclusively on public transit. It’s very important to them. They don’t own cars, but they still need to get here for work, to see friends and family."

But is a 1.7-mile stretch of subway the right priority for and the right way to spend San Francisco’s scarce transportation money? Tom Radulovich, elected BART board member and executive director of Livable City, said making the Central Subway a top priority is a "big mistake."

"If everything else was well with Muni, this might be a good project," he told us. "But we need to take care of first things first."

Radulovich emphasized that improving the existing Muni service is a better step toward resolving San Francisco’s transit problems. He pointed out that using state and federal government money for other projects would go a lot further in improving the overall system. He said the Central Subway project is prematurely being made a priority.

"It’s like trying to build a master bedroom suite on top of a foundation that needs reinforcement. It’s nice, but it doesn’t make much sense," he said.

When asked about the possibility of revamping the Muni bus lines that presently serve Chinatown, Pak explained that the existing bus service already functions at capacity.

"Stockton is one of the busiest streets in San Francisco," she said. "Have you ever tried to ride a bus there at rush hour? It’s almost impossible."

In fact, the project’s Supplemental Environment Impact Report states that bus service already runs at three-minute frequencies or better for most of the Central Subway corridor. It also affirms that the area is operating at capacity, "particularly Stockton Street."

Pak added that the Central Subway would allow for shorter transit times and a "minimum disruption of surface streets."

After the Embarcadero Freeway was disabled by the 1989 Loma Prieta earthquake, the decision was made to remove and not replace it. That angered many Chinatown merchants, who became the base of support for the Central Subway project.

At first the group "didn’t have the muscle nor the power," Pak told us. "But our community rallied. We did massive letter writing and postcard writing."

Now challenging the project or raising concerns about its cost or feasibility — which some critics and media reports have done — means doing battle with Pak and the Chinese American community, a substantial voting block. So Mayor Gavin Newsom, Sup. Peskin, and other top elected officials support the project.

At the San Francisco Planning Commission meeting held Nov. 15, David Chiu, a commissioner on the Small Business Commission (and candidate to succeed Peskin as District 3 supervisor), said he was "really looking forward to this project moving forward" but would like to see more detail in the SEIR about the process for relocating small businesses.

Commissioner Michael Antonini "strongly advised" extending the subway as soon as possible to North Beach and Fisherman’s Wharf and all the way to the Richmond, arguing the current terminus in Chinatown doesn’t make long-term sense. But few at the hearing argued the project shouldn’t be built.

According to the SEIR, traveling from Fourth Street and King to Chinatown on the Central Subway would cut up to 12.4 minutes from the journey in 2030 — from the bus time projection of 17 minutes to less than five minutes in one subway alignment alternative.

Four "Alignment Alternatives," or designs for how the subway will be built, are laid out in the SEIR, which was released for public review Oct. 17 and made the subject of three community workshops and a Planning Commission hearing.

Options range from enhanced bus service and no subway to one that includes some surface rail along Fourth Street (with a new station at Moscone Center) to an option with more of the route underground and Chinatown stations in various spots.

Once an alignment plan is chosen, the SFMTA will vote on the final design next year. And if things go smoothly, construction on the project could start in 2010 and service begin in 2016.

Obama’s moment

Barack Obama came to San Francisco with some pretty heavy baggage Nov. 14. His speech at the Bill Graham Civic Auditorium was swarmed by a diverse crowd of about 7,000, with most of those we interviewed hungry for an answer to the big question: is Obama the one who can take this troubled country in a new direction?

The Illinois senator had just gotten a bump from a cover story in the Atlantic, "Why Obama Matters," which posits that he is the only candidate capable of moving our country past the divisive culture-war paradigms and into a period when fundamental change is possible.

But time is running out for Obama to take the Democratic presidential nomination from front-runner Hillary Clinton, who has locked up moderates and most women. And some progressives, including labor unions, are behind John Edwards. To win the nomination, Obama must find a way to quickly rally the left — including urban voters and the antiwar, social justice, LGBT, and labor movements — into an energized voting block.

And that, some progressives say, means he’s got to stop playing it safe.

Days before the speech, former California state senator and 1960s radical Tom Hayden sent Obama a letter taking issue with the latter’s comment that Democrats are paralyzed by Vietnam-era fights — and in particular, his response, "That’s just not my framework."

Hayden argued that Obama was squandering his advantage as the sole credible antiwar candidate by running a safe campaign that equally repudiates both political extremes — even though progressives have been far closer to the truth on issues of war, civil rights, economic equity, and the full range of traditional Democratic planks.

Hayden wrote, "The greatest gift you have been given by history is that as the elected tribune of a revived democracy, you could change America’s dismal role in the world. Because of what you so eloquently represent, you could convince the world to give America a new hearing, even a new respect. There are no plazas large enough for the crowds that would listen to your every word, wondering if you are the one the whole world is waiting for. They would not wait for long, of course. But they would passionately want to give you the space to reset the American direction."

Many attendees of Obama’s SF speech shared similar sentiments. "I’m interested in what he’s been saying in his books, but he’s become a kind of politician, so I want to hear what he has to say tonight," Jeremy Umland, 33, a third grade teacher from Oakland, said as he was waiting in line. "I think he had a lot of brave ideas in the past, and I’d like to see him get back to that."

Umland, who is white and gay, stood with his partner, Terrence Marks, 34, who is black. The couple are in the process of adopting a child and wanted to hear Obama call for legalizing gay marriage or for a health care plan that doesn’t involve insurance companies.

"I’d like to see him address it in a way that doesn’t evade this issue," Marks said. "I want to hear him talk not like a politician, but a real person."

Inside, Obama gave voice to many of those same themes.
"Running the same old textbook, by the numbers, Washington campaign just won’t do it…. The triangulation and poll-tested positions because we’re afraid of what Mitt [Romney] or Rudy [Giuliani] will say about us just won’t do it," Obama said, adding, "If we’re going to seize the moment, then we can’t live in fear of losing."

He said we are in "a defining moment in our history," when Americans need to grapple with war, a planet in peril, economic insecurity, and a political system that seems corrupt and incompetent. "We’ve lost faith that our leaders can or will do anything about it," Obama said.

Over and over again, Obama said he is running to deal with the most difficult issues: living wages, universal health care, human rights and dignity, racial harmony, honest foreign diplomacy, and a return to the principles of the New Deal. "I’m running for president of the United States because that is the party that America needs us to be right now.

"I am in this race," he said, "because of what Dr. King called the fierce urgency of now."

Good stuff, but is it too late? "I don’t see it happening, but it’s still possible that Hillary Clinton will slip in Iowa. She’s not invincible," Hayden told us.

In fact, a new ABC–Washington Post poll shows Obama taking the lead over Clinton in Iowa, 30 percent to 26, with Edwards at 22 percent.

"Seeing him through the eyes of my 34-year-old son and his wife, I could see there was a lot of new excitement among the younger generation and that it would be a shame if that just dissipates," Hayden told us. "The thing Obama needs most is what he steers around: he need a new social justice movement similar in strength to what we had in the ’60s."

Donald Fowler, a San Francisco resident and Democratic Party campaign consultant who ran John Kerry’s Michigan campaign in 2004 and Al Gore’s field operation in 2000, said Obama has suffered for trying to communicate detailed positions through an intense media filter.

"You get into the danger of running a government when you should be running a campaign," Fowler told us.

He and Hayden each said that particularly on the Iraq war issue, where Obama is strongest, he should have projected his stance more boldly, something he may now be starting to do.

"My guess is they have decided to be strong, state things clearly, and take back the discussion," Fowler said. Listening to Obama discuss this moment, that assessment seems likely.

"It’s because of these failures that people are listening intently," Obama said. "We have the chance to come together to form a new majority." *

An Appeal to Barack Obama

“The Democrats have been stuck in the arguments of Vietnam, which means that either you’re a Scoop Jackson Democrat or you’re a Tom Hayden Democrat and you’re suspicious of any military action. And that’s just not my framework.” – Sen. Barack Obama.

Barack, I thought Hillary Clinton was known as the Great Triangulator, but you are learning well. The problem with setting up false polarities to position yourself in the “center”, however, is that it’s unproductive both politically and intellectually.

Politically, it is a mistake because there last time I looked there were a whole lot more “Tom Hayden Democrats” voting in the California primary and, I suspect, around the country, than “‘Scoop’ Jackson Democrats.” In fact, they are your greatest potential base, aside from African-American voters, in a multi-candidate primary.

More disturbing is what happens to the mind by setting up these polarities. To take a “centrist” position, one calculates the equal distance between two “extremes.” It doesn’t matter if one “extreme” is closer to the truth. All that matters is achieving the equidistance. This means the presumably “extreme” view is prevented from having a fair hearing, which would require abandoning the imaginary center. And it invites the “extreme” to become more “extreme” in order to pull the candidate’s thinking in a more progressive direction. The process of substantive thinking is corroded by the priority of political positioning.

I have been enthused by the crowds you draw, by the excitement you instill in my son and daughter-in-law, by the seeds of inspiration you plant in our seven-year old [biracial] kid. I love the alternative American narrative you weave on the stump, one in which once-radical social movements ultimately create a better America step by step. I very much respect your senior advisers like David Axelrod, who figured out a way to elect Harold Washington mayor of Chicago. You are a truly global figure in this age of globalization.

But as the months wear on, I see a problem of the potential being squandered. Hillary Clinton already occupies the political center. John Edwards holds the populist labor/left. And that leaves you with a transcendent vision in search of a constituency.

Your opposition to the Iraq War could have distinguished you, but it became more parsed than pronounced. All the nuance might please the New York Times’ Michael Gordon, who helped get us into this madness in the first place, but the slivers of difference appear too narrow for many voters to notice. Clinton’s plan, such as it is, amounts to six more years of thousands of American troops in Iraq [at least]. Your proposal is to remove combat troops by mid-2010, while leaving thousands of advisers trying to train a dysfunctional Iraqi army, and adding that you might re-invade to stave off ethnic genocide. Lately, you have said the mission of your residual American force would be more limited than the Clinton proposal. You would commit trainers, for example, only if the Iraqi government engages in reconciliation and abandons sectarian policing. You would not embed American trainers in the crossfire of combat. This nuancing avoids the tough and obvious question of what to do with the sectarian Frankenstein monster we have funded, armed and trained in the Baghdad Interior Ministry. The Jones Commission recently proposed “scrapping” the Iraqi police service. Do you agree? The Center for American Progress, directed by Bill Clinton’s former chief of staff, is urging that all US troops, including trainers, be redeployed this year. Why do you disagree? Lately you have taken advantage of Hillary Clinton’s hawkishness on Iran to oppose bombing that country without Congressional authorization. But you carefully decline to say whether you would support bombing Iran when and if the time comes.

This caution has a history:

– you were against the war in 2002 because it was a “dumb war”,
but you had to point out that you were not against all wars, without
exactly saying what wars you favored;

– then you visited Iraq for 36 hours and “could only marvel at
the ability of our government to essentially erect entire cities
within hostile territory”;

– then as the quagmire deepened, you cloaked yourself in the
bipartisan mantle of the Baker-Hamilton Study Group, which advocated
leaving thousands of American troops in Iraq to fight terrorism, train
the Iraqis until they “stand up”, and sundry other tasks of
occupation;

Perhaps your national security advisers are getting to you when it should be the other way around. Their expertise is not in the politics of primaries. If anything, they reject the of populist peace pressure influencing elite national security decisions. The result is a frustration towards all the Democratic candidates for what the Center for American Progress has recently called “strategic drift.” The political result is the danger of returning to John Kerry’s muffled message in 2004. The policy result may be a total security disaster for our country, draining our young soldiers’ blood and everyone’s taxes on the continuing degradation of our national honor in a war which cannot be won.

Just for the record, let me tell you my position on Iraq. I think the only alternative is to begin a global diplomatic peace offensive starting with a commitment to withdraw all our troops as rapidly as possible. That is the only way to engage the world, including the Iraqi factions, in doing something about containing the crises of refugees, reconciliation and reconstruction. It means negotiating with Iran rather than escautf8g to a broader war. If you want to “turn a new page”, it should not be about leaving the Sixties behind. It will be about leaving behind the superpower fantasies of both the neo-conservatives and your humanitarian hawks. And yes, it is to be “suspicious”, as Eisenhower and John Kennedy came to be suspicious, of the advice of any Wise Men or security experts who advocated the military occupation of Iraq. Is that position as extreme as your rhetoric assumes?

Your problem, if I may say so out loud, and with all respect, is that the deepest rationale for your running for president is the one that you dare not mention very much, which is that you are an African-American with the possibility of becoming president. The quiet implication of your centrism is that all races can live beyond the present divisions, in the higher reality above the dualities. You may be right. You see the problems Hillary Clinton encounters every time she implies that she wants to shatter all those glass ceilings and empower a woman, a product of the feminist movement, to be president? Same problem. So here’s my question: how can you say let’s “turn the page” and leave all those Sixties’ quarrels behind us if we dare not talk freely in public places about a black man or a woman being president? Doesn’t that reveal that on some very deep level that we are not yet ready to “turn the page”?

When you think about it, these should be wonderful choices, not forbidden topics. John Edwards can’t be left out either, for his dramatic and, once again, unstated role as yet another reformed white male southerner seeking America’s acceptance, like Carter, Clinton and Gore before him. Or Bill Richardson trying to surface the long-neglected national issues of Latinos. I think these all these underlying narratives, of blacks, women, white southerners and la raza – excuse me, Hispanic-Americans – are far more moving, engaging and electorally-important than the dry details of policy.

What I cannot understand is your apparent attempt to sever, or at least distance yourself, from the Sixties generation, though we remain your single greatest supporting constituency. I can understand, I suppose, your need to define yourself as a American rather than a black American, as if some people need to be reassured over and over. I don’t know if those people will vote for you.

You were ten years old when the Sixties ended, so it is the formative story of your childhood. The polarizations that you want to transcend today began with life-and-death issues that were imposed on us. No one chose to be “extreme” or “militant” as a lifestyle preference. It was an extreme situation that produced us. On one side were armed segregationists, on the other peaceful black youth. On one side were the destroyers of Vietnam, on the other were those who refused to
submit to orders. On the one side were those keeping women in inferior roles, on the other were those demanding an equal rights amendment. On one side were those injecting chemical poisons into our rivers, soils, air and blood streams, on the other were the defenders of the natural world. On one side were the perpetrators of big money politics, on the other were keepers of the plain democratic tradition. Does anyonebelieve those conflicts are behind us?

I can understand, in my old age, someone wanting to dissociate from the extremes to which some of us were driven by the times. That seems to be the ticket to legitimacy in the theater of the media and cultural gatekeepers. I went through a similar process in 1982 when I ran for the legislature, reassuring voters that I wasn’t “the angry young man that I used to be.” I won the election, and then the Republicans objected to my being seated anyway! Holding the idea that the opposites of the Sixties were equally extreme or morally equivalent is to risk denying where you came from and what made your opportunities possible. You surely understand that you are one of the finest descendants of the whole Sixties generation, not some hybrid formed by the clashing opposites of that time. We want to be proud of the role we may have played in all you have become, and not be considered baggage to be discarded on your ascent. You recognize this primal truth when you stand on the bridge in Selma, Alabama, basking in the glory of those who were there when you were three years old. But you can’t have it both ways, revering the Selma march while trying to “turn the page” on the past.

This brings me back to why you want to stand in the presumed center against the “Tom Hayden Democrats.” Are you are equally distant from the “George McGovern Democrats.”, and the “Jesse Jackson Democrats”? How about the “Martin Luther King Democrats”, the “Cesar Chavez Democrats”, the “Gloria Steinem Democrats”? Where does it end?

What about the “Bobby Kennedy Democrats”? I sat listening to you last year at an RFK human rights event in our capital. I was sitting behind Ethel Kennedy and several of her children, all of whom take more progressive stands than anyone currently leading the national Democratic Party. They were applauding you, supporting your candidacy, and trying to persuade me that you were not just another charismatic candidate but the one we have been waiting for.

Will you live up to the standard set by Bobby Kennedy in 1968? He who sat with Cesar Chavez at the breaking of the fast, he who enlisted civil rights and women activists in his crusade, who questioned the Gross National Product as immoral, who dialogued with people like myself about ending the war and poverty? Yes, Bobby appealed to cops and priests and Richard Daley too, but in 1968 he never distanced himself from the dispossessed, the farmworkers, the folksingers, the war resisters, nor the poets of the powerless. He walked among us.

The greatest gift you have been given by history is that as the elected tribune of a revived democracy, you could change America’s dismal role in the world. Because of what you so eloquently represent, you could convince the world to give America a new hearing, even a new respect. There are no plazas large enough for the crowds that would listen to your every word, wondering if you are the one the whole world is waiting for. They would not wait for long, of course. But they would passionately want to give you the space to reset the American direction.

What is the risk, after all? If “think globally, act locally” ever made any sense, this is the time, and you are the prophet. If you want to be mainstream, look to the forgotten mainstream. You don’t even have to leave the Democratic Party. It’s time to renew the best legacy of the Good Neighbor policy of Roosevelt before it dissolved into the Cold War, the Strangelove priesthood, the CIA coups in Iran and Guatemala, the sordid Bay of Pigs, the open graves of Vietnam. It’s time to renew the best legacy of the New Deal before it became Neo-Liberalism, and finally achieve the 1948 Democratic vision of national health care.

May you – and Hillary too – live up to the potential, the gift of the past, prepared for you in the dreams not only of our fathers, but of all those generations with hopes of not being forgotten.

The reel world

Among the coverage of the horrific San Francisco Bay oil slick, I saw a short video of a fowl gliding through sea glimmering with petroleum. The bird maintained grace in this toxic environment, navigating marbled, paperlike swirls in the blackened water. That image had an indelibly uncomfortable beauty, the sort that occurs in Takeshi Murata’s videos, in which cinema — transferred to digital media — begins to transmogrify into something that slithers like mercury and soaks into our psyches.

His current show at the recently relocated and vastly expanded Ratio 3 gallery is centered on a new six-minute work, Escape Spirit VideoSlime, though the addition of another piece, Untitled (Pink Dot) (2006) creates a satisfying double bill. Both works feature buzzing electronic soundtracks by Robert Beatty, vivid acid-trip color schemes, and not-so-veiled references to environmentalism. Escape, the more narrative of the pair, was created with generic nature footage of chimps in the forest, while Pink Dot appropriates scenes from Rambo: First Blood. In both, Murata deconstructs the imagery. Pixels reveal their capacity to act like paint, then reconfigure into fleeting photographic images of animals, explosions, and consuming, liquefied landscapes. They evoke a morass, an underworld similar to Barbarella’s Matmos, befitting the term VideoSlime and its promise of creaming the virtual.

The pieces are screened in separate stalls, yet if you stand between them they can be viewed simultaneously. Their ominous soundtracks, however, constantly blend together into somewhat overdetermined eeriness. Both are nightmarishly memorable, though the graphic quality and the recognizable but surprisingly earnest use of Stallone make Pink a somewhat stronger work. In totality, Murata’s project fits a contemporary moment in which the digital and the analog are merging in ever more complex and perhaps confusing ways. His work can be seen in context with groups such as PaperRad and a number of young artists who create neopsychedelia from Saturday-morning cartoon detritus and the comforting, rudimentary digital nature of Pac-Man. Murata has mined this territory in earlier works such as Monster Movie (2005), but what set his recent projects apart are the sophistication and complexity of the visions.

His 2006 piece Untitled (Silver) — seen in Murata’s first show at Ratio 3 and in "Cosmic Wonder" at the Yerba Buena Center for the Arts — is a knockout, with its metallic gray footage of horror-film star Barbara Steele floating through a well-appointed goth interior that undergoes Murata’s process of liquefaction. Silver may still be the artist’s benchmark, but these new works reveal he’s got plenty of fuel left in the continually tenuous worlds, both actual and media, that we inhabit.

SUPER EGO Books are cool, and they can make you taller. Often they even tell you things, things you never thought you’d want to know. They’re like platform heels that talk! But they speak in a flippant whisper, and what they say is delicious.

Sure, books may not be able to dish on how Tyra got rid of her "vag arms" this season (hello, Scotch tape in her hairy pits) or why that one annoying girl on the 22 Fillmore’s still pumping that goddamn "Hot Pocket, drop it" song on her tinny-ass cell phone over and over, a mound of discarded sunflower seed shells scattered around her pastel Superfecta IIs. (Please go download some Lupe Fiasco "Superstar" to your knockoff Chocolate already, sweetie. Seriously. It’s November.)

What books can tell you sometimes is that you’re right. I love that! Take The Warhol Economy: How Fashion, Art, and Music Drive New York City, by Elizabeth Currid, a new spine that fingerless-gloved intellectuals are cracking all over the Muni. It basically argues that — fuck Wall Street — the arts are the real forces that drive Manhattan’s hopping money market. (Too bad the best new artists can only afford to live in Queens now.) And guess where the linchpins are? Where art, fashion, and music intersect and all the brainy hotties trade lucrative ideas? That’s right: night clubs. All the fabbest deals are made on the dance floor, Ms. Elizabeth says, and nightlife, in which "creative minds set the future trends," should be boosted to top priority by any wannabe successful city, extralegal activities be damned. Of course she’s talking about New York, so her tome’s a tad inapt for our little blow jobs–for–tourists trade show here. But still, nightlife rules! One day it’ll make us all rich and famous! In your face, space coyote.

Speaking of books: I once dated a tech bear. It was the mid-’90s, the Interweb was still shiny, and bears hadn’t morphed into hedge-trimmed candy ravers yet. Don’t hate! Tech bears were hot — I’m still an all-day sucker for them — and this one, like so many others of his ilk, not only could build a Unix server out of two Cherry Coke cans and a pizza box but also spent his nights tripping on krunk and composing ambient electronic odes to his heroes Brian Eno and Arthur Russell. I couldn’t drag his ass onto a dance floor to save my life, but his windowless bedroom in the Tenderloin was a glittery cornucopia of strobe effects and rapid-fire bleeps. Go figure.

If only there had been some kind of school for him to attend, some place that would have guided him toward a career in digital-audio arts before he blew his mind on meth and moved back to the Midwest to become a gay trucker for Montgomery Ward!

Better late than never, maybe; now there is. Pyramind, a full-on media music and production school, is taking over SoMa and providing some of San Francisco’s brightest club-music makers with the skills to conquer the digital world. I recently found myself being chaperoned, somewhat bewildered, through Pyramind’s labyrinthine main campus by director and president Greg Gordon, in the company of old-school dance floor mover and shaker Paul dB. As they led me from one cavernous, soundproofed room to the next, each full of top-flight equipment, giant projection screens, a plethora of enormous monitors, and some mighty fine-looking students, I realized: maybe I should just give up writing and start composing the soundtrack for Halo 4. I could help launch a puke-colored Mountain Dew energy drink in 2009!

My temporary flight of fancy — how could I ever give up getting kind of paid to down well-vodka cosmos and introduce you to several psycho drag queens almost every week? — wasn’t such a pie in the sky. Pyramind’s hooked up with major prestidigitalators like Apple, Ableton, Digidesign, M-Audio, and Propellerhead. Students get possible career leads and exposure to some of the biggest biggies — Pyramind calls these companies "strategic partners," but to me a strategic partner is someone you sleep with to get back at your ex.

But the school is just part of a grand master plan. Pyramind is octopoid, with recording studios, a distribution service, international programs, a music label called Epiphyte headed by industry legend Steffan Franz, a well-established musical showcase–club night called TestPress that’s expanding to other cities (and has spawned an Epiphyte-released CD of bouncy tunes), and, with the recent acquisition of another huge campus a few doors down from the main one, an independent party venue. Pyramind’s stacked. And hey, in case any terrorists were thinking of hijacking any future Pixar productions (although wasn’t Cars terrifying enough?), Pyramind’s got the seal of approval, I shit you not, from Homeland Security. Calling all tech bears: drop that Cheeto and get in the digi-know now.

Gobblin’ Cobain

SONIC REDUCER For too many, Thanksgiving is all about high-priced, high-stress flights home for the holidays, foul fowl, sad slipcovers, and relatives who rove the spectrum from irksome to inspirational. Why the last? I have to say that one miserable Turkey Day spent on the outskirts of Des Moines, Iowa, meeting a squeeze’s enraged and estranged parents while his jock brother dented my Geo Metro during a show-off game of tag football brought me closer to thoughts of suicide than ever before. Thanksgiving: the most annoying event before and since Oracle OpenWorld (only with a tad fewer leering conventioneers)? Discuss.

So it’s fitting, then, that soon-to-be uncomfortably bloated thoughts once again turn to the late Kurt Cobain with the Nov. 30 theatrical release of Kurt Cobain about a Son and the Nov. 30 droppage of Unplugged in New York, the DVD release of Nirvana’s 1993 MTV Unplugged appearance. I watched both 14 years to the day after the band’s Unplugged taping, on Nov. 18. If I weren’t already terrified of tying on the turducken, I’d be totally spooked by the synchronicity: are you sure Halloween is over?

AJ Schnack’s doc About a Son reads like a ghostly document: Cobain’s disembodied voice floats over its entirety, drawn from tapes of 1992–93 interviews conducted by coproducer Michael Azerrad for his book Come as You Are: The Story of Nirvana (Main Street, 1993). Beneath the songwriter’s thoughts, Schnack chooses to float images of everyday romance and poetry captured in Cobain’s northwestern haunts: power lines shoot across the sky, dead birds rot beneath burnished sunsets, kids play music in alleyways. Relying on an evocative score by Steve Fisk and Ben Gibbard and songs by Queen, David Bowie, and others that are related to the interviews, Schnack eschews Nirvana’s music and even their photographic image until the very end. He prefers to immerse the viewer in the edited, intimate thoughts of Cobain, who can genuinely touch and surprise a listener with stories of how he felt abandoned by his father and his honesty about his misanthropy (coworkers "get on my nerves so bad I either have to confront them and tell them I hate their guts or ignore them"), heroin use (of his $400 per day self-medicating efforts to stem his chronic stomach pain, he says, "I was healthier and fatter than I am now"), and hatred of the media ("the most ruthless life form on Earth"). By turns moving and excruciating, About a Son raises as many questions as it answers.

Eerily dovetailing with About a Son by way of a cover of Bowie’s "The Man Who Sold the World" and a Queen joke regarding ex–Germs guitarist Pat Smear, the Unplugged performance has long been loaded with the stuff of quintuple-putf8um legend and fan speculation regarding Cobain’s death, which occurred just four months after the program aired on Dec. 14, 1993 on MTV. How else to parse the lyrical references to guns, the white lily set decorations (Cobain’s idea), and the set list’s intermittent aura of doom? In any case, Nirvana completists will want to snag this for the unedited 66-minute concert, which includes two numbers excised from the original 44-minute broadcast: Nirvana’s "Something in the Way" and the Meat Puppets’ "Oh Me." The mistakes and occasional sour notes remain. I was surprised by the general lack of energy in the band; the ordinarily forceful Dave Grohl sounds painfully unsure on brushes. But the conviction, seriousness, and soulfulness of Cobain’s vocal performance make this entire endeavor worthwhile — despite the gritted-teeth grin and protruding tongue that follow the first few songs.

You strain to hear the dialogue between the band members and betwixt Cobain and the audience. When the band seems to dither over the last song, one female audience member yells, "<0x2009>‘Rape Me’!" "Is that Kennedy?" someone asks, referring to the noxious alterna-VJ of the day. "I don’t think MTV will let us play that," Cobain replies with an insouciant, knowing air. If you’re still looking for that classic Gen X cynicism, look no further than MTV, which seems to have ditched music programming in general.

So why did Cobain sing for his TV dinner in the first place? Was it simply because In Utero (DGC, 1993) wasn’t selling well? Just months before his passing, Cobain already looked like another pop idol prepping to die young and leave a gorgeous corpse. Or not. Nonetheless, here, bird-boned with downcast eyes, he edges closer to that beautiful boy outlined in Elizabeth Peyton’s paintings, ready to assume his place in a pantheon of perpetually doodled, iconographic heartthrobs, right after Jim Morrison and James Dean. Nirvana was a great band — but as so many know who were there, cognizant, and occasionally coherent when Nevermind (Geffen, 1991) hit, there were lots of great bands. Ever the authentic article, Cobain knew this as much as any other, which is why he always gave a hand to forebears, bringing on the Meat Puppets (much to the disappointment of MTV, according to an accompanying DVD short) and sporting a T-shirt of the SF all-female art-punk combo Frightwig for this performance. Did it simply take Cobain’s dramatic death to, as an MTV executive dork opines in the short, turn an "interesting, eclectic performance" into "a masterpiece"? Neither of these spooked offerings really fits that descriptor, but for the faithful they might do till another comes along. *

Milking it

Here are a few things I learned at Saturday’s debate among the three Senate candidates, which was sponsored by the Harvey Milk LGLT Democratic Club:
– Mark Leno is desperately seeking Milk’s endorsement and thinks he can get it by pointedly attacking and trying to discredit incumbent Carole Migden (a strategy that may backfire).
– When shoved, Migden shoves back hard (also a strategy that may backfire).
– Joe Alioto-Veronese doesn’t belong on the same stage as Leno or Migden — and, frankly, doesn’t seem ready for a Senate race (being named “Alioto” just ain’t enough) — but he clearly thinks he can run to the right of the main event and have a shot.
– I came up with far too many questions for my role on the media panel at the event, and maybe I should have worn something a bit more stylish.
– There’s still a very long way to go in this race…and it ain’t gonna be pretty.

Non grata in Venezuela

Well, I’m non grata in the Venezuela of Hugo Chavez and so are hundreds of other members of the InterAmerican Press Association (IAPA), a hemispheric free press organization based in Miami.

I’m off early tomorrow morning, Nov.17, as a member of an IAPA delegation visiting Venezuela to try to put some pressure on Chavez and his accelerating crackdown on press freedom.

Earl Maucker, IAPA’s president and editor and senior vice president of the South Florida Sun-Sentinel in Ft. Lauderdale, put it this way, “Once again we are here in Venezuela to demonstrate our solidarity with journalists and news media at a time when they are facing difficulties in carrying out their daily task of providing information to the Venezuelan people and to request that in the constitutional reform process absolute guarantees be given that freedom of the press will exist in full.”

This will be the l0th time during the Chavez administration that IAPA officers are visiting Caracas.
IAPA has stated that over the past six months, the Chavez government has committed more “transgressions: against the press than has any other country in the Western Hemisphere.

Chavez has countered by saying he does not recognize the legitimacy of IAPA. He declared the organization invalid through Parliament. The National Assembly declared that IAPA “feeds lies and misinformation in the media” and has declared the members “non grata,” according to Reuters. IAPA is so “non grata” to Chavez that his administration is making it difficult for IAPA to hold its March assembly in Venezuela, which has been scheduled for two years.
Three hotels in three different Venezuelan cities first accepted, then mysteriously canceled, IAPA’s reservations for its mid year meeting. The first two hotels told IAPA that they had no vacancies. The third hotel said it would provide rooms, but that the group could not use its conference facilities.

The delegation will try to meet with Chavez and is scheduled to meet with government officials, members of civil society, and individual journalists and representatives of the news media.

We will wind up our mission with a press conference on Tuesday, Nov. 20. I’ll keep you posted. B3

Hearing on corporate welfare for airlines

A disingenuous ploy (reported by us but mostly ignored by the other media outlets in town) by the Hotel Council and Sup. Michela Alioto-Pier to have San Francisco taxpayers give millions of dollars in corporate welfare payments to the national airlines will be heard Monday at 11 a.m. by the Board of Supervisors Government Audit and Oversight Committee. The three-person committee is weighted in favor of the conservatives on the board, and this will likely be the only opportunity for public testimony, so come by the board chambers if you want to help counter the politically influential Hotel Council. Also on the agenda is a proposal by Alioto-Pier to increase taxi gate fees.

Behind the Bey empire

Since 2003, Esperanza Johnson, a former key figure within Oakland’s Bey organization, and her husband, Antron Thurman, have acquired nearly $2 million worth of East Bay real estate through a string of controversial deals tainted with allegations of deceit.

In five cases those deals led to litigation. Johnson, of Antioch, who also goes by the name Noor Jehan Bey, has twice been accused of fraud. Court records indicate that one of those transactions involved falsified documents.

One sale involving Johnson, a licensed real estate broker, led to criminal charges: Alameda County prosecutors in 2006 convicted a Johnson associate on fraud charges stemming from a deal that cost an East Oakland couple their home.

A broad array of characters have tangled with Johnson and Thurman in court, including a disabled Berkeley bus porter forced from his family home, an Antioch couple now facing foreclosure, and East Bay Habitat for Humanity, a nonprofit organization that builds homes for the poor and struggling. Combined, they claim to have lost at least $1.77 million in property, cash and equity in the deals.

The revelations about Johnson and Thurman come as authorities scrutinize the extensive real estate dealings of the Bey family and their bankrupt business, Your Black Muslim Bakery, including Johnson’s role as the broker for an Oakland woman named Paulette Arbuckle who is attempting to buy the bakery’s San Pablo Avenue headquarters. Johnson bore four of the Bey family patriarch’s dozens of children.

Bakery CEO Yusuf Ali Bey IV, 21, jailed without bail on kidnapping and torture charges, also is charged with real estate fraud: prosecutors say he bought an Oakland property under a false identity.

And bankruptcy trustee Tevis Thompson, who is overseeing the liquidation of Your Black Muslim Bakery’s assets, has claimed in court papers that Bey IV transferred $2.28 million in bakery properties to his mother, Daulet Bey, in a bid to “defraud creditors.” The trustee has sued for those properties’ return.

Devaughndre Broussard, a 20-year-old bakery associate, is charged with the Aug. 2 shotgun slaying of Oakland Post Editor Chauncey Bailey as he walked to work in downtown Oakland. Police say Broussard made a confession – later recanted – that he killed Bailey because the journalist was working on a story about the bakery’s finances and bankruptcy case.

Johnson, whose state business registration was suspended more than a year ago for failure to pay taxes and who with Thurman has more than $1 million in state and federal tax liens recorded against them, didn’t return numerous telephone calls and emails, and didn’t answer the gate at her Antioch home on two recent occasions.

Thurman refused to speak to reporters who approached him recently in Oakland.

A Los Angeles real estate consultant who reviewed Johnson’s transactions for the Chauncey Bailey Project said the trustee and judge handling the bakery’s bankruptcy should examine Johnson’s record.

They “should be made aware that a realtor on a transaction which requires the trustee’s approval has a murky… background,” said Eric Forster.

The attorney for the court appointed bankruptcy trustee charged with liquidating the bakery said Johnson’s transaction history would be probed.

“Obviously it is of some concern to us and we’re looking into it,” Eric Nyberg, attorney for trustee Tevis Thompson, said when informed of the cases.

He also noted that Arbuckle may not, in the end, be the highest bidder for the bakery. A hearing on her offer is scheduled for Nov. 29. If the $899,999 bid of Johnson’s client, Arbuckle, is successful and Johnson is “entitled to receive the commission, then we really don’t have an issue with it,” Nyberg said.

A spokesperson for the state Department of Real Estate, Tom Pool, wouldn’t discuss the Johnson and Thurman transactions.

Machado

Markus Machado and Gail Mateo said that when they wanted to buy a newer and bigger home in 2005, they went to a real estate broker they thought they could trust: Esperanza Johnson.

A Compton native, Johnson became involved with the Bey organization, a spin-off of the Nation of Islam, at the age of 12, taking the name Noor Jehan Bey.

She’s returned to using the name Esperanza Johnson, though she’s been listed in judgments against her by banks and credit-card companies as Nellie Bey, Nuri Bey, Noojean Bey and Noor Jehan Esperanza, a review of records by the Chauncey Bailey Project shows. And, in 2005 testimony, she said she still occasionally uses the name Noor Jehan Bey.

Johnson had hired Machado, a graphic artist, to create flyers for her Signature One Mortgage and Real Estate.

In a recent interview at his lawyer’s office, Machado described her as warm and gregarious – at first, anyway. Machado said Johnson arranged what seemed like an incredible deal: the couple could sell their 50-year-old Pittsburg house and move into a spacious four-bedroom home in a verdant Antioch subdivision, an ideal place to raise their three children and grow old together.

Johnson promised they’d pay about $1,600 a month for the new home, only a little more than their mortgage at the time. Machado said Johnson even agreed to forgo her usual commissions “because we were like family.”

They said Johnson had told them their credit was poor, and talked them into selling their Pittsburg house to one of her employees, Araceli Moreno, for $350,000 while putting the new home and mortgage in Moreno’s name as well. They expected to refinance the loan in about a year, when Moreno would sign the house over to them.

It seemed perfect – until the bills arrived.

The payments were $2,700 a month and soon ballooned higher, they now say in court records. And then Johnson – who in sealing the deal had diverted almost $58,000 of equity from their old home to others, and had won large commissions for herself by getting them an unfavorable mortgage – stopped taking their calls, Machado said as his wife sat next to him weeping.

The couple had trouble making the payments almost immediately and Moreno began receiving calls from the mortgage company. She sued Machado and Mateo last year.

“The point of (Moreno’s) lawsuit was to get them to refinance to get my client’s name off the loan and for her to go ahead and salvage what of her credit picture she could,” said Moreno’s attorney, Richard G. Hyppa of Tracy.

The couple counter-sued in November 2006, naming Moreno and Johnson as defendants, claiming that Johnson defrauded them. They are now months behind on the payments and stressed to exhaustion.

“I don’t sleep. Gail doesn’t sleep,” Machado said. “I was very naive. We were led down this primrose path because I trusted (Johnson) implicitly.”

After paying off what they owed on the Pittsburg house, about $190,000 was left over that should have been used for the down payment on the Antioch house. But the suit alleges that Moreno used only $77,973 toward the down payment.

Meanwhile, court records say Johnson arranged for another $10,000 to be paid out to Moreno, and for someone named Harry Hawkins to get $45,830 as “repayment of loans.” Machado’s lawyer, Ken Koenen, said attempts to locate Hawkins have been fruitless.

The suit also claims Johnson structured the Antioch mortgage so monthly payments would increase dramatically after a year, and so Machado and Mateo would have to pay an $18,000 penalty in order to refinance – thereby earning her a much larger commission.

Machado and Mateo now are several months in arrears on the mortgage in Moreno’s name. Default notices have arrived at the house.

“It’s an extremely painful thing,” Machado said. “We have been robbed of our peace of mind. We have to make decisions about whether to put food in the refrigerator or gas in the car. We’ve not even sure we’re going to have a place to live.”

Johnson hasn’t responded to the couple’s lawsuit and will likely be subject to a default judgment, Koenen said.

Chicago D&P
Johnson and Thurman in 2004 acquired a Hercules home after a federal judge had ordered it frozen as an asset of an investment company, Chicago D&P, that the U.S. Securities and Exchange Commission had accused of fraud.
The property was supposed to be sold to help pay back investors – reportedly including at least 30 active-duty Marines and several churches – which had been cheated out of millions through Chicago D&P’s pyramid schemes.
The daughter of the company’s president had bought the property years earlier using a straw purchaser – a friend with better credit – as a front, according to court records.
That friend had been trying to get her name off the title for some time, and the daughter’s attorney – Githaiga Ramsey, who also worked for Thurman and Johnson on another case – persuaded her to sign the house over to them. Records shows Ramsey offered the friend $20,500 to complete the transaction but that the payment was never made.
The transfer of the house occurred after U.S. District Court Judge Charles Breyer ordered the property frozen. Thurman then turned around and sold it a month later to one of the employees of his bail bond business, Jamie Bonilla, for $460,000. Johnson filed Bonilla’s loan application.
Most of that money appears to have eventually gone to pay mortgages against the property when Thurman and Johnson acquired it for free. But first, Thurman received $60,213 from the deal’s escrow; and Ramsey got $31,000.
It remains unclear who lived in the house after Bonilla bought it.
Stephen Anderson, the receiver representing Chicago D&P’s bilked investors, wrote in April 2005 that he believed Johnson’s daughter, Nisa Bey, had lived there.
Other documents show Madeeah Bey – another mother to several of patriarch Yusuf Bey’s children – used it as her mailing address in two December 2004 real estate deals.
It’s also unclear whether Thurman and Johnson knew of the court order freezing the house when they took possession of it. But in February 2005 Breyer held Ramsey in contempt of court for defying his order.
Ramsey and Thurman both repaid the money they received from the escrow when Thurman sold the house to Bonilla.
Bonilla, within a few months, then sold the house for $625,000 – a profit of $211,690 from a property that the receiver had originally wanted to sell to help repay the defrauded investors.
Anderson said a long legal battle to regain title to the house would’ve been too costly.
“We made an economic decision,” he said. “The objective of the receiver is to return as much money as possible back to the investors, and it was not difficult to determine we were going to get more money” by taking the $91,000 from Thurman and Ramsey than by “trying to unscramble that whole mess.”
Ramsey, who surrendered his law license while facing disciplinary charges from an unrelated case, wouldn’t discuss this case or others in which he was involved with Johnson and Thurman.
“My God, am I never going to get away from this?” he said. “I’m not involved and I don’t want to be. I’m not in contact with these people anymore.”
Bonilla could not be located.
Habitat for Humanity house
Antron Thurman married a woman named Sharon Clements in December 1987. Records show they separated seven months later and eventually filed for a divorce that was never made final.

In early 2000, Clements, as a single mother, moved into a home on 105th Avenue in Oakland built by the low-income housing nonprofit East Bay Habitat for Humanity. It gave Clements a no-interest $112,000 loan with no down payment.

Clements died in April 2003, leaving no will. Usually either there’s a clear legal inheritance, or else the nonprofit passes the deed to someone qualified for low-income aid, executive director Janice Jensen said. But Clements’ son was still a minor.

Clements’ home stood vacant for three years while her estate was sorted out in Alameda County Probate Court.

Then, in mid-2006, Thurman argued he was entitled to the low-income property as Clements’ surviving spouse, records show – even as he listed his address as Johnson’s Antioch home, and other records showed that in the previous few years he had bought and sold in excess of $1 million in East Bay real estate.

“Frankly, I didn’t even know about Mr. Thurman,” Habitat’s Jensen said. “I had no idea who he was or that he even existed until the attorneys got involved. When we looked at the deed, she was the only signature, so she bought that home herself.”

Still, Alameda County Superior Court Judge Marshall L. Whitley awarded Thurman the house, which had restrictions in place to preserve its affordability for low income people.

Thurman then sold it back to Habitat for Humanity for the $13,500 in equity that had accrued during the three years Clements owned it.

Alana Conner, an attorney for Thurman at the time, said she couldn’t independently recall details of the case and declined to discuss it.

Stewart

Mitzie Peters befriended Brandy Stewart in 2001, studying the Bible with her eventual victim, court records say.

Peters persuaded the cash-strapped AC Transit bus driver to deed the home at 1565 77th Ave. – which Stewart had inherited from her mother, and in which she, her husband and her three children lived – into Peters name and use Peters’ credit to get an equity loan. Peters promised to return the deed after a few days, keeping $12,000 from the loan as a fee.

“She said that because she loved me so much, she would never, ever think about doing this for anyone else, but she would help me to get the house refinanced,” Stewart would later testify.

Stewart deeded the house to Peters on March 11, 2003. But rather than sticking to the deal, Peters drained the property of all equity and gave nothing to Stewart, court records show.

Peters couldn’t have conducted the transaction without Johnson and her family.

As Peters’ broker, Johnson submitted a series of loan applications reporting Peters’ income as increasingly higher until the bank accepted the deal; she also allegedly coached Stewart in writing to the title company and falsely claiming Peters was her cousin.

Johnson’s sister, Ruquayya Jasmine Pennix, prepared Peters’ tax returns to send to the loan company, showing self-employment income that Peters later admitted was bogus; it’s unclear if Pennix knew that at the time.

Another of Johnson’s sisters – Fatima Ismail, who worked in Johnson’s office – drew up a phony lease showing Peters had derived rental income from Stewart’s house, according to court records.

Three months after she took title to Stewart’s house, Peters sold it to one of Johnson’s sons, Amir Bey. Under oath, Amir Bey later admitted he was just a straw buyer for his mother.

When arrested and charged with unrelated public benefits fraud, perjury and grand theft in July 2004, Peters made bail with Thurman’s Sinbad’s Bail Bonds.

As investigators also began probing her real estate activities, Peters gifted her Hayward condo to Johnson’s daughter, Nisa Bey, who sold it a month later for about $400,000.

Peters then lived with Nisa Bey in Pittsburg until going to prison. Because her bail had been secured with the condo, Thurman later asked a judge to exonerate the bail and return more than $50,000 – to Nisa Bey.

The Alameda County District Attorney’s office interviewed Johnson, Thurman, and their attorney, Githaiga Ramsey – who had represented Peters until just two months earlier, and who had just arranged the Chicago D&P deal for them – in September 2004.

“Johnson seemed evasive when questioned about irregularities in the loan and application process,” inspector Paul Wallace wrote in court papers.

But Johnson wasn’t charged.

“We didn’t think we could prove the case against her beyond a reasonable doubt,” Deputy District Attorney Alyce Sandbach said. “We didn’t have enough to make her on a case of fraud… of having made knowing misrepresentations.”

Among additional charges filed against Peters in November 2004 was a felony grand-theft count for equity and title to the Stewarts’ home; she pleaded no contest to that and 15 other, unrelated counts a year later, and was sentenced in February 2006.

The Stewarts got the $50,374.10 bail money Thurman had tried to direct to Nisa Bey. A judge in January ordered Peters to pay $486,083.90 in the Stewarts’ civil lawsuit, but they haven’t seen a dime, their lawyers say.

Amir Bey and Johnson tried to evict the Stewarts, court documents show, but backed off when the couple obtained free legal help.

The Stewarts then sued Johnson, Peters and Amir Bey; Johnson eventually offered to deed the house back to Stewart, but with the equity drained, the Stewarts couldn’t afford the higher mortgage payments.

A judge in September 2006 ordered Johnson and Amir Bey to pay the Stewarts $100,000 – $20,000 up front and $1,667 per month for 48 months.

Rebecca Saelao, the Stewarts’ attorney, said this civil judgment became a lien on the house, and was subordinated to massive mortgages Johnson and Amir Bey had taken on the property and eventually defaulted on. The house was sold at auction last year for $80,900, public records show.

The Stewarts got only about $5,000 from the sale of the home they’d lost. They no longer live in the Bay Area, and couldn’t be reached for comment.

Taylor

Wrapped in a thin, sea-green blanket, Donald Taylor lay in a narrow bed at a Stockton nursing home recently, his frail 61-year-old body ravaged by diabetes and hypertension. His wheelchair was parked at his bedside, a walker he wants to learn to use, a few feet away.

Taylor is broke and relies on Medi-Cal, the state insurance program for the indigent, to bankroll his care and board at the Elm Haven Care Center.

His room is dingy and, fluorescent-lit with peeling blue wallpaper and a television, foil wrapped around its rabbit-ear antennae, issuing forth static-filled sound. He spends his days “just doing nothing.”

He said he wonders what his life might be like now if he never encountered Antron Thurman. “I think about it quite often, but there’s nothing I can do… I think about how they took the house from me,” Taylor said haltingly in a soft, gravelly voice that contained little emotion.

In the 1950s Taylor’s parents bought a cozy two-bedroom home on a tree-shaded street in north Berkeley. He grew up there and lived there still as an adult, while working as a bus-station porter. When his parents died, he and his sister, Loretta Alexander, inherited the house; the mortgage was paid off.

In early 2001, according to interviews and court documents, stepbrother Frederick Myers Jr., approached the siblings with a plan: He would help them form a company to manage the house and another property they had inherited, an undeveloped Lake County parcel.

Myers asked them to transfer the two deeds to the new corporation, which he would helm for them. Taylor said he agreed at his sister’s urging, believing the three of them could profit from development of the Lake County parcel.

But Myers suddenly sold the Berkeley house to Thurman, pocketed hundreds of thousands of dollars and disappeared, court documents say, catching Taylor and Alexander completely off guard.

“I felt I had been cheated,” Taylor said, adding that he believes Thurman and Myers worked in concert. “Fred Jr. took the house and sold it to (Thurman) and it’s been downhill ever since. He sold it out from underneath us.”

Myers could not be located. Thurman, asked if he remembered Taylor, refused to answer as he climbed into a Cadillac Escalade outside a home in the Oakland hills.

Alexander’s son, Tony Cole, expressed disgust at the way his mother and uncle were played. “That property slipped right out from underneath them,” he said in a phone interview. “They didn’t have the business sense to know what was going on.”

Taylor and Alexander in 2004 sued to reclaim the house. Myers never appeared in court, but Thurman – represented by Githaiga Ramsey – responded by filing his own suit, claiming he had legitimately bought the property for $374,388 and demanding that Taylor pay $1,500 in monthly rent or get out.

Taylor and Alexander eventually settled the case for $55,000; it took Thurman 10 months to pay them, court records indicate. Taylor’s attorney, Frederic Harvey, refused to discuss the case.

The two-story, beige stucco house with a large garage has steadily appreciated in value. Public records show Thurman sold it in 2004 to Madeeah Bey – the same relative who used the Chicago D&P house in Hercules as her address – for $520,000; she sold it for $850,000 less than a year later. The house is now assessed at $867,000.

Alexander died last year. Taylor lost most of his possessions including photos of his mother when he left the property.

“I’d like to tell him to go (screw) himself,” Taylor said of Thurman, his legs twitching quietly under the blanket.

Why I voted for Josh Wolf

TECHSPLOITATION Last week’s mayoral election in my hometown of San Francisco was one of those weird moments that make you think you’re living in a Philip K. Dick novel, looking at hundreds of alternate futures peeling away from the present like little slivers of psychosis. It was a dismal election, in which the incumbent, conservative–for–San Francisco Gavin Newsom, was the only candidate who had any hope of winning. He was practically unopposed, but there was, technically, a cornucopia of candidates, spanning the gamut from qualified but unpopular to completely unqualified and silly, who were on the ballot running against him.

Things being what they are, the silly candidates got the most attention (albeit not most of the votes). Some guy named Chicken, known mostly for his participation in the art festival Burning Man, ran on a campaign pushing people to vote for him as their second choice, since San Francisco has ranked-choice voting. He definitely had great posters, given his connection to the arts community, but not much of a platform. Then there was the sex club owner Michael Powers, who ran on a platform I never quite understood. Powers does have one of the nicest sex clubs I’ve ever seen, called (appropriately enough) the Power Exchange, and I wondered briefly if that might qualify him to run the city. But in the end, he got the fewest votes. And Chicken did not come in anywhere near second.

As I said, there were a few candidates, like Quintin Mecke, with relevant experience, but none had big enough constituencies to pull off a win. So when it came time to fill in my ballot, I voted for a guy who isn’t a joke and has the kinds of political experience that might get him elected in 2035: Josh Wolf.

Media geeks may remember Wolf as the blogger who was sent to prison for refusing to identify for the police some protesters in video he posted of a political demonstration that turned violent. After he got out of prison he went on the Colbert Report, where he came across as well intentioned and with a burning passion for free speech. In the mayoral race, he ran on a platform that emphasized open democratic processes and a good wi-fi plan for the city. Nobody in his campaign thought he would win, and indeed he only garnered about 1,500 votes. But that’s saying something in an election with only 17 percent turnout.

So why didn’t I vote for somebody like Mecke, who had a good position on dealing with homelessness and had already done some work in city politics? Because, as I said, I felt like I was in this Dick novel looking into a zillion possible futures right there in the polling place. There were the sure-to-fail futures represented by good candidates with no hope of winning, and then there was the dark future of creepy joke candidates like Chicken, whose mockery of the voting process was probably part of why so few people turned out for the election. Why vote when running for mayor had been turned into a joke?

So I voted for the best possible future I could find, the future in which, eventually, smart young people who care about freedom of expression online become mature politicians who understand new technologies and the socioeconomic conditions associated with them. Maybe Wolf won’t grow into that politician, but somebody like him will. And that person will probably understand things like how to organize Internet access for low-income city residents and why entertainment companies shouldn’t be allowed to sue people for hundreds of thousands of dollars because they’ve been file-sharing. That person will also understand how easy it is to violate people’s privacy online and will push for regulations that prevent companies and governments from dipping into private digital data supplies.

Of course, the future in which we have politicians like Wolf may never happen. We can’t predict what will become of him, and we can’t know if digital natives will mature into progressives who care about access and privacy reforms. There’s always room for wired neocons and digital Puritans, whose intimate history with the Internet will make them particularly good at legisutf8g censorship purges and invasive data mining. That’s not the future I voted for, but I am always having to remind myself that’s the future I may get. *

Ethics under attack

A group of political campaign treasurers who regularly handle the financial nuances of reporting election cash have signed a letter disparaging the operations of San Francisco’s Ethics Commission.

"Fewer and fewer of our members are willing to accept San Francisco local candidates and committees as clients because of the hostile environment that now exists," reads a July 23 missive addressed to the five Ethics commissioners and posted by the Los Angeles–based California Political Treasurers Association.

The letter includes a laundry list of gripes, including that Ethics staff treat treasurers like criminals; the audit, fines, and penalty processes are too slow; forfeitures of campaign donations for minor reporting errors are unfair; penalties for some infractions are unjust; there’s been no guidance on a new law banning donations from corporations; and that when screwups occur the paid, professional treasurers are treated more harshly than volunteers.

Twenty-one CPTA members signed the letter, and several echoed its contents at a Nov. 8 meeting with Ethics staff.

"Honestly, our firm will probably never touch a San Francisco ballot measure again," said Stacy Owens of Oakland’s Henry C. Levy and Co.

However, Ethics staff refuted some of those complaints.

For example, the treasurers universally decried the requirement that a donor have a street address as well as a post office box. "It’s stupid," said Kevin Henegen of the Sutton Law Firm, who did not sign the letter but did attend the Nov. 8 meeting.

But it’s a law throughout California, not just in San Francisco. "The state considers this very serious," said Oliver Luby, the fines collection officer of the Ethics Commission and the most outspoken staffer at the meeting. He pointed out that a street address can be used to verify the physical existence of a donor, while a PO box can easily shield a false identity.

Some of the treasurers said the quick pace of campaigning can turn the search for a simple street address into a battle, and the threat of a fine or forfeiture from the Ethics Commission causes them to consider not reporting the donation at all until after the election, when the address can be less hurriedly determined.

That’s a problem, according to Charles Marsteller, a good-government watchdog instrumental in the drafting of many of San Francisco’s campaign rules. He told us he’d like to see legislation that addresses the treasurers’ concerns while ensuring timely disclosure: "We don’t want to see a situation where two days before the election a large donation is not reported because the donor fails to disclose an address or occupation. This might give a handy excuse to justify not reporting things like large 11th-hour media buys."

The treasurers further complained that their being on the hook for a fine, fee, or forfeiture when a client screws up isn’t fair and that the past errors of a group shouldn’t affect how it’s treated in the future.

If a committee breaks the law and owes money, the treasurer is legally responsible, but these paid professionals could act as filers instead and leave the name of treasurer and any monetary penalties to one of the committee members, as Luby told us.

While the treasurers complained that forfeitures of donations for reporting errors are a penalty that no other California jurisdiction imposes, Luby said that San Francisco hasn’t enforced them since 2002.

He also penned a detailed 17-page memo responding to the CPTA’s complaints, which includes a matrix showing that most of the signers of the letter don’t do business in San Francisco and only 4 of the 21 have had to pay fines here since 2002.

While he argues that those four are disgruntled professionals who have tangled with Ethics in the past, he does not entirely dismiss the CPTA’s observations of serious management inconsistencies at Ethics. In particular, he cites the perception of unfairness when routine late fees and fines, which he handles, are wrapped up in campaign investigations — which are conducted, in secret, by another sector of Ethics and can result in different monetary penalties. Over the years the standards for fines have dissolved as secret deals have been cut to settle investigations.

"Since my arrival in 2002, my mantra for penalties has been consistency, consistency, consistency," Luby writes. "By routinely being a stickler for standards over the years, I have detected the Commission management prefers greater flexibility when regarding when to grant a waiver. In particular, waiver standards have been applied inconsistently when late fees and forfeitures are incorporated with investigative penalties."

The CPTA asked for a task force to fully vet solutions to some of Ethics’ problems, which Commissioner Emi Gusukuma said she’d be willing to join. "This is a great first step," she said of the Nov. 8 meeting, which she and Commissioner Jamienne Studley attended. "But it’s still a big, meaty issue."

John St. Croix, executive director of Ethics, said the agency will be taking these issues seriously. "There’s a lot of frustration because people don’t know what our processes are," he said. "If we are being unfair, we can normalize our processes."

Goldie winner — Dance: Shinichi Iova-Koga

Shinichi Iova-Koga’s work is grotesque, beautiful, and funny. As a dancer he is never less than mesmerizing — ephemeral like smoke, limpid like a vernal pool. And yet he is an accidental dancer. The son of two painters, he was initially drawn to photography; at age 12 his bathroom doubled as a darkroom. Then, at San Francisco State University, he became a film major. "All the while," he says, "I was involved in theater, but I thought my main line was behind the camera."

The Oakland-born Iova-Koga also trained in Tadashi Suzuki’s method for actors, through which he was introduced to Butoh. Another influence was the investigative method of Ruth Zaporah’s Action Theater. His most formative teacher, however, was Butoh dancer Hiroko Tamano: "While we were making rice balls one day, [Tamano] asked me if I wanted to join Harupin-Ha [Butoh Dance Theater]." After a while, like many of Tamano’s pupils, Iova-Koga needed to strike out on his own. He traveled to Japan and Germany to study and work with other Butoh masters and, not incidentally, learn to adapt the genre to his expressive needs.

Thanks to these shifts in focus, he has developed a personal form of mixed-media dance theater that integrates contradictory impulses — the ancient and the technological, the chaotic and the formal, nature and nurture. He might be called a dancer at the edge. To Iova-Koga, this may well be a compliment; he has said that "only a dance at the edge reveals the honest life." His process blurs the distinctions between categories of thinking, being, disciplines, and performing. He likes to dig into both humorous and horrible subjects. The resulting works have taken him around the world.

One of his early works, 1996’s Desert Body, showed dramatic flair but not much personal voice. Ironically, he says, "I first started with Butoh so that I could be a better director. Now by chance I am a dancer." He is very precise about what this means to him. Dancing, he has said, means "focusing on the body being danced. To mentally construct a choreography that ignores this is to create a false dance."

Iova-Koga is an avid solo performer as well as a collaborator; he is often inspired by the people around him. His harrowing Tasting an Ocean — influenced by his father’s having lived through the atomic bombing of Nagasaki at the age of five — kept a 2003 audience at the tiny Noh Space on the edge of their seats. His most recent, highly acclaimed solo, Milk Traces, which he has performed in Europe and Japan, was prompted by the birth of his daughter. He calls her his main teacher now: "I follow her without questions."

In ensemble pieces such as Heaven’s Radio, an adaptation of a Samuel Beckett radio drama, and this summer’s Our Breath Is as Thin as a Hummingbird’s Spine (cocreated with Nanos Operetta), Iova-Koga has worked with other Bay Area theater artists (Nils Frykdahl, Ken Rudstrom, and Allen Willner) and Butoh dancers Tanya Calamoneri and Leigh Evans. The duet Ame to Ame, featuring Yuko Kaseki, another Germany-based frequent collaborator, finds the two playing out a riotous male-female relationship in terms of both meanings of the word ame, Japanese for "candy" and "rain." The absurdist Cockroach casts Kaseki as the ghostly wife to Iova-Koga’s husband; she dances through his tea-slurping last moments. His newest enterprise is C(h)ord, which he’s collaborating on with Seattle’s Degenerate Ensemble. It premieres at the Yerba Buena Center for the Arts on April 24, 2008.
