San Francisco progressives celebrated the movement’s election night victories and set their sights on the mayor’s office during a party last night at The Independent sponsored by the San Francisco Democratic Party, San Francisco Labor Council, and the SF Tenants Union.
“The progressives in San Francisco still need the real prize and that’s Room 200,” said Aaron Peskin, who will continue in his role as chair of the local Democratic Party after leaving the Board of Supervisors at the end of the year.
He wasn’t the only one looking forward. John Avalos, who won the Dist. 11 seat on the Board of Supervisor, praised the unified movement’s ability to withstand withering attacks by downtown-funded groups and said, “Together, we can take the mayor’s race in 2011.”

Wonder as they wander

The great Langston Hughes titled a volume of his autobiography I Wonder as I Wander, invoking the notion of the poet in terms entirely personal and inevitably representative of a whole people, violently unsettled by history and restlessly searching for meaning, home, dignity — in short, for themselves. In Hughes’ art, this dovetailed with the image of the poet as blues singer and the blues singer as poet. His writing signaled that vernacular music as secular and sacred verse to a population caught up in forces larger than itself, but marked nevertheless by millions of singular experiences given individual voice in song.

The same themes of displacement and song run compellingly throughout the late August Wilson’s magisterial 10-play cycle of the African American 20th century, and rarely as forcefully as in 1988’s Joe Turner’s Come and Gone, currently receiving director Delroy Lindo’s fine, impressively cast production at the Berkeley Rep. But Hughes’ title applies readily to another great historical population as treated in another revival this month, making the stories evoked in Joe Turner and Traveling Jewish Theatre’s less successful The Last Yiddish Poet touchstones of broadly but pointedly similar significance.

Set in 1911 during the great migration of African Americans northward, Joe Turner‘s action unfolds in Pittsburgh’s Hill District. The setting is a boardinghouse operated by the basically decent but huffy Seth Holly (Barry Shabaka Henley) and his kindhearted wife, Bertha (Kim Staunton). Into this warm, burnished house comes a small assortment of transient borders, all more or less fresh from the South: the headstrong guitar player and manual laborer Jeremy (Don Guillory), the lovelorn Mattie (Tiffany Michelle Thompson), and the fiercely independent beauty Molly (Erica Peeples).

They join a more permanent lodger, pigeon-catching backyard shaman Bynum Walker (Brent Jennings). The Hollys are descendants of Northern freemen, but the others are a mere generation from slavery — possibly excepting Bynum, old enough to have been born a slave, and not counting the play’s lone white character, merchant Rutherford Selig (Dan Hiatt), who, as a descendant of slave catchers, has adapted unselfconsciously as a "people finder" among rootless African American migrants.

The main plot of Wilson’s evocative, earthy, and humor-laden tale of disunion, reunion, and fractured identities takes hold with the arrival of the grimly forlorn, vaguely menacing Herald Loomis (Teagle F. Bougere). Loomis’ story makes bitter sense of the play’s title, a blues lyric repeated throughout by Bynum and fashioned by Southern women whose men were disappeared and forced into labor by the infamous Joe Turner. Since his release from bondage, the anguished and haunted Loomis, a former deacon, has searched with trancelike focus for the mother of his shy daughter (Inglish Amore Hills, alternating with Nia Reneé Warren). The Hollys’ boardinghouse takes on the baleful aspect of Loomis entombed soul as his violent outbursts of protest and revelation — and the mediating, ministering wisdom of the perspicacious, wondering Bynum — edge the play beyond naturalism toward a mythopoesis of half-submerged history.

The resurrection of history and half-buried tradition, as well as the literal voicing of experience and identity, is also at the center of The Last Yiddish Poet, an otherwise very different kind of play from Joe Turner. Originally produced by Traveling Jewish Theatre in 1980 and now revived to lead off its 30th-anniversary season, the production is aptly peripatetic in structure as well as theme: two actors in vaudevillian comic getup (artistic director Aaron Davidman and TJT cofounder Corey Fischer, also the play’s cocreator and half of the original cast) roam about a limbolike white-on-white set scattered with occasional detritus, most particularly and strikingly a pyramidal display at the far left of the stage on which a mound of books lie in disarray. The actors eventually mount a low stage within the stage, behind a row of modest footlights composed of painted tin cans, and amid knowing cornball lines they announce that they are speaking in "Yiddish" accents, despite not knowing Yiddish, so that the audience will recognize their Yankee selves as Jews.

What follows is a reclamation of the language as a search for identity and authenticity, in several dramatic and musical modes and moods and in struggle with manifold forces of history, from assimilation to persecution to the blunt inconstancy of time itself. Director, cocreator, and TJT cofounder Naomi Newman admits in her program notes that reentering the play after many years was not as easy as expected. Much has changed with respect to the place of Yiddish in Jewish lives. There is a quality of hesitation in the updated staging, which undermines some of its poignancy, although the awkwardness disappears at key moments, including Fischer’s hulking, half-masked portrayal of Nakhman — the rebbe known for contributions spiritual and literary in Yiddish — and second-generation TJT artist Davidman’s channeling of formerly unfamiliar Yiddish verses, in what amounts to an act of possession in at least two senses. *

SONIC REDUCER All allusions to Guns ‘N Roses much-contemplated, way-overthought, über-delayed ejaculation Chinese Democracy (Interscope) aside — is there such a thing as being too brainy or geeky to rock? Some might have pegged the cerebral, multi-syllable-slinging Decemberists as such: with its Brit-wave and Elephant 6 pop-literati influences, the band seemed to herald an aughtsy-totsy wave of archly smart indie pop (e.g., Arcade Fire) that drew from both stage-y American standards and college-radio playlists — theirs was less college rock than a college-educated rock. Add in the renown surrounding Decemberists’ 2005 San Francisco show, which cut "Chimbley Sweep" with a light saber duel, and eventually touched off playful competition with Stephen Colbert, and you’ve gotta wonder, how nerdy can one band get?

Well, attribute it to roving minds and too much drink, according to ever-cogitating, multi-tasking band leader Colin Meloy, 34. "I try not to be totally static onstage," drawls the songwriter by phone from his Portland, Ore., home as his 2-year-old son freaks out. "Typically if I go see a rock show, I just want to see a rock show and have the songs speak for themselves. But we’ll do gags, audience participation. Stuff born out of boredom and drunkenness."

Meloy and company’s restive imaginations most recently spawned a series of three singles titled Always the Bridesmaid, composed of tunes recorded last March but which weren’t quite right for the group’s March 2009 Capitol album, The Hazards of Love. The first 12-inch included "Valerie Plame," a jubilant shout-out, bustling with feisty accordion and brass, to the all-too-exposed CIA operative. "I would be listing to the radio and making dinner and hearing about Valerie Plame and what struck me was how perfectly the cadence of her name was for a pop song," Meloy explains. "’Valerie’ has been used in a lot of pop songs — there’s something about the first stressed syllable in a three-syllable name and the cadence onward, and the beautiful punctuation of the last name. It was just screaming to have a pop song written around it."

The last single — with the prettily melancholic, banjo-bedecked "Record Year" and the wistful, acoustic guitar-glittered "Raincoat Song" — comes next month. "I think it might be the only thing we ever released in December," quips Meloy.

As for the long-awaited LP, which the combo will likely play in its entirety on tour next spring, Meloy describes it as an "experimental narrative" forged after listening to a lot of old folk songs as filtered through ’60s-era British revivalists. "I noticed common elements were popping up and I thought it would be interesting to take those individual elements and throw them together in an extended song and see what sort of narrative it would create," he says.

"These days, to be a musician and to be constantly immersed in music, your outlook on music changes drastically," continues Meloy. "I find I rarely get the spine-tingling moments from music anymore. I think I’m jaded and immersed — you know how you work in a pizza place and get sick of pizza — and the spine-tingling moments are few and far between, but I find I’m rediscovering those moments in old folk songs. I find it in songs that make me weepy but have been around for centuries." *

The comedy duo didn’t go entirely up in smoke with the ’80s: so-called "grumpy old stoners" Cheech and Chong return to the Bay for their first show in SF in, like, forever (Chong said manager Lou Adler’s feud with Bill Graham led to their blackballing), with a concert film in the works. How has the gray matter been, retaining the routines? "It’s all body memory," says the personable Chong, 70, from his Arizona stop. He attributes his skills and timing to writing and playing music. Taxi merger

A plan to merge the Taxi Commission with the Municipal Transportation Agency will be heard by the Board of Supervisors on Nov. 25. Most city officials and taxi industry bigwigs support the change, but some drivers fear it could signal the end of the semi-autonomous medallion system that has been in place for 30 years.

The merger legislation by Sup. Aaron Peskin is brief, simply transferring duties from the Taxi Commission to the MTA beginning March 1, 2009. But Peskin also helped write another key piece of legislation — last year’s sweeping MTA reform measure Proposition A — that contains a provision allowing the MTA to wipe out all prior taxi regulations.

Skeptics fear that the real target of the merger is Prop. K, the 1978 law that created the current driver permitting system, which requires taxi medallions that are owned by the city to be in every car. With the MTA in control, the door could be open to privatizing taxi medallions. These permits are currently leased by the city for a fee — $658 a year for most cabs — to longtime drivers, but a scheme to sell or transfer them could mean huge profits for the select group of drivers who now hold medallions, with a potentially high transfer fee kicked back to the city.

Reguutf8g San Francisco’s taxi industry involves ensuring cabs are being properly operated, with medallions held by legitimate drivers, and investigating various complaints. But the Taxi Commission barely has enough money to meet its mandate. Proponents of the merger say the MTA can bring more resources and professional attention to the industry. Mayor Gavin Newsom, who as a supervisor in 1998 pushed for formation of the Taxi Commission, has long supported the merger as a way to have all transportation housed in one agency.

“The benefit of merging is the MTA already regulates all surface transportation,” said Jordanna Thigpen, acting director of the Taxi Commission, who was appointed by Newsom after the Taxi Commission ousted Heidi Machen in 2006. “Most cities in the country do incorporate taxis into the common transportation agency.”

Currently, cab companies, medallion holders, and rank and file drivers essentially function as a feudal system, with the serfs driving San Franciscans around in vehicles usually owned by the lording cab companies and permitted by older drivers who hold the coveted medallions. There are only 1,500 of these permits, which are literally tin medallions that correspond to the numbers printed on the sides of cabs. They are owned and regulated by the city, and leased for life to drivers who wait years to move up the list.

Medallion holders make about $20,000 to $50,000 per year leasing their medallions to cab companies, which then charge drivers daily “gate fees” that are set by the city. Drivers pay an average of $96.50 per day to use a cab, but are allowed to pocket all their fares. Drivers usually clear about $150 a day, but that’s before paying gas, tolls, and tickets, and before even sometimes allegedly slipping bribes to dispatchers to get the best assignments. Drivers have no health insurance and are essentially treated as independent contractors.

Drivers have criticized the newly formed Taxi Advisory Group, which has made recommendations to the MTA and is likely to be expanded after the merger into a 15-member council, which would have only three drivers, but seven medallion holders and cab company representatives. Five members of the public would also be seated and their unanimous support would be required for a driver-led initiative or idea to trump the medallion and cab company bloc.

“We want a much greater and fairer representation on this Taxi Advisory Council,” said driver and United Taxicab Workers chair Bud Hazelkorn. “Without that, all the issues that we bring will not be heard.” Those issues include providing health care for drivers and creating a centralized dispatch system so fares are allocated more equitably. He pointed out that drivers are the only people in the system making all their income directly from fares. Everyone else in the industry gets slices from other pies.

And the existing provisions outlined by Prop. K may soon be a thing of the past.

Prop. A included language that allowed for the Taxi Commission merger and stated that once the MTA was in control, “Agency regulations shall thereafter supersede all previously adopted ordinances governing motor vehicles for hire that conflict with or duplicate such regulations.”

During the 2007 election season, this was interpreted by the UTW and Judge Quentin Kopp, a former supervisor who authored Prop. K, as possibly undermining the current medallion system. “The taxicabs CEOs have tried EIGHT times to undo Prop. K, failing each time as voters upheld this good government measure,” Kopp wrote in a paid ballot argument at the time. “Now encouraged by City Hall, Prop. A slips in a deceptive clause undoing 30 years of voter policy.”

Back in 2007, when seeking the Guardian‘s endorsement for Prop. A, Peskin told us, “I have met with the mayor. The mayor has no desire, as do I, to undermine Prop. K, and what we would do if we ever were to transfer the Taxi Commission to MTA, we would transfer upon the condition that they adhere to and embrace by regulation all of the previously voter approved ordinances, such as Prop. K. So I think we have it handled.”

Peskin said he reaffirmed that commitment in a letter, cosigned by Newsom, but neither office could locate a copy of that letter as of Guardian press time.

But at a Nov. 17 Government Audit and Oversight Committee meeting, Peskin asked MTA executive director Nathaniel Ford if it was his understanding that this merger was not to undermine Prop. K. “That is my understanding,” said Ford. “I think it is important to all stakeholders.”

Yet the interpretation is still correct. “The MTA will now have the authority to enact provisions that supersede Prop. K,” City Attorney’s Office spokesperson Matt Dorsey told the Guardian.

This past summer, the Taxi Commission established a Charter Reform Workgroup with a primary goal of reviewing Prop. K. The group is expected to meet for about six months with any recommendations subject to a citywide vote.

Although the workgroup has yet to release any specific statements regarding Prop. K, chairman Malcolm Heinecke believes it’s already making strides simply by opening up public discourse among citizens, companies, medallion holders, and drivers.

“One of the problems with the taxi industry and discussions of reform is that they are very insular,” said Heinecke, who is also an MTA board member. “I believe we have a balanced group of voices [in the group].”

Heinecke said he thinks varied stakeholders are essential because of broad dissatisfaction with Prop. K. “You hear everyone — both inside and outside the industry — bemoaning some aspect of Prop. K. It’s a system we’ve had in place for 30 years; rather than just say it’s bad and not do anything, [the goal of the workgroup] is to look at where we are and revise.”

While it may be true that no one is satisfied, that hardly means members of the factional workgroup agree on how exactly Prop. K should be changed. For some, the problem begins with issues of representation. Not everyone agrees with Heinecke that this is a “balanced group.” Of 12 members, there are just three drivers and three members of the public, with the rest representatives from the upper echelons of the industry.

Driver and UTW member Thomas George Williams pointed out that “companies and medallion holders often have the same interests — most companies are owned by medallion holders.”

Furthermore, Mark Gruberg, a UTW member, told us, “Everyone would say some things can and possibly should be done to improve provisions of Prop. K. But it’s one thing to work around the edges to reform a law and another thing to throw it out the window.”

He pointed out that one proposal before the workgroup would allow medallions to be sold for profit, something he said “would be a complete reversal of Prop. K.” If other cities are an example, medallions could fetch as much as $500,000 apiece, enough for the holder to retire handsomely. “People that have them would clean up at the expense of the next generation of cab drivers,” Gruberg said. “It would be a completely indefensible windfall.”

“This is public property, these medallions,” Hazelkorn said. “They could be misused as a pension, but that’s not a pension that applies to everyone.”

When questioned, Heinecke was vague about concrete changes the workgroup might instigate. “This is a delicate position for me because the whole purpose of the task force is to hear the views of all the stakeholders,” he said.

Taxi drivers, the serfs of the industry, do not have high hopes about the merger. “If the merger happens, the MTA [officials] will be able to do whatever they please,” Williams said. “Everyone knows MTA is always in need of money … they don’t care about drivers or improving industry, only their budget.”

Williams worries that, under the MTA, the commission will lease medallions to companies instead of individual drivers, which would “totally ruin the concept of Prop. K.” Gruberg agreed. He pointed out that some proposals mention levying a tax on the medallion transfers, a potential revenue source the MTA could be eyeing. “It’s a whole new ball game with MTA and if they’re so desperate for cash and they see the taxi industry as a cash cow, they might go for any scheme.”

MTA spokesperson Judson True told us, “We have no intention of looking to taxi revenue to supplement existing Muni operations.”

Judge Kopp said, “By itself that does not disturb Prop. K, but if that’s a fig leaf for some recommendation from this ersatz Charter Reform Workgroup, then it becomes ominous.” He said dressing the changes in a group with a pithy name like Charter Reform “is not reform, it’s subterfuge.”

And, he added, Prop. K doesn’t need reform as much as it needs enforcement. “They’ve been at this for 30 years. Their revisions are always to start to restore the pre-1978 conditions and enable them to treat these permits as personal possessions for sale.”

Peskin, with the approval of other members of the committee, calendared the full board hearing on the merger for a date after the MTA announces the result, expected sometime this week, of its national search for a director of taxi and accessible services. Solid leadership has been elusive: two years ago the Taxi Commission fired executive director Heidi Machen, reportedly for being too tough on cab companies. Machen was replaced by another Newsom appointee, Jordanna Thigpen, who said she has applied to stay on the job but doesn’t know if she’ll be selected.

When asked if the merger would unnecessarily stretch the MTA’s resources, Thigpen said, “On the one hand you could look at it that way. On the other hand, we’re so chronically understaffed. Trying to add staff is so complicated because we’re funded by the taxi industry.”

The taxi industry brings about $1.6 million in revenue to the city, mostly from fees paid by 1,500 medallion holders and about 7,000 drivers. However, “Fees do not currently meet the city’s cost recovery needs,” according to a Taxi Commission merger report. “Both Taxi Commission and Taxi Detail are understaffed and additional enforcement personnel are needed.”

MTA’s True said, “We expect some cost savings or at least increased efficiencies,” when asked how the merger will affect the MTA’s budget. “When it comes to changing Prop. K, raising fees, or adjusting how medallions are allocated,” True said, “I can’t say that it’s not on the table … In the last several months the focus has been on procedural issues. I think that policy questions will largely come post-merger.”

Think global, shop local

It’s so easy to shop online. And it’s easy to go to a big chain store and pick up all your bargains in one place. And in the end, what does it get you?
Not that much.

San Francisco is full of neighborhoods that are full of locally-owned, independent businesses. They’re part of the flavor of the city, part of the reason we all live here. Their taxes pay for libraries and parks and schools. Their owners are active in the community, hiring local people and keeping the streets alive. And they exist only because people shop there.

When you shop locally, you get a lot more. "When you shop online, your money could be going across the Earth," explained Marc Caposino, managing partner of Fresh Public, a marketing firm that has a city contract to promote local shopping. "The character of our neighborhoods is based on local shopping, and if we don’t pay attention to that, we’ll lose it."

You also do a lot to help the economy in this deepening recession. Every dollar you spend in a locally-owned business circulates through the local economy; the local bookstore owner takes the money and spends it at the local shoe store, where the owner spends it at a local restaurant — and all that helps the recovery. If you spend the same dollar at a chain store or shopping online, the profits are whisked out of town instantly.

The numbers are pretty dramatic. Based on an analysis provided by the Business Alliance for Local Living Economies, using a formula created by the consulting firm Civic Economics, if every one of the Guardian‘s 593,000 readers spends $100 of their holiday money shopping at a local business, that would inject $99 million into the San Francisco economy. That’s nearly $15 million more dollars than we would see if that money was spent in chain stores.

The Guardian is part of a national shop-local campaign, coordinated through the Association of Alternative Newsweeklies. The city of San Francisco has a shop-local effort too, as does Oakland. Many other cities are picking up the theme.

And it’s not as if you have to give up anything. I learned long ago that most local bookstores can offer the same service as Amazon.com. If you want a book your local independent store doesn’t carry, the folks there can order it for you and get it just as fast as Amazon can — and you won’t even pay shipping charges. "If you’re looking for something specific, you can probably get it somewhere in San Francisco," Caposino said. It’s worth a few minutes to look.

Pair an effusive and extroverted, larger-than-life politico like Harvey Milk — complete with community-forging charisma, panoramic outlook, and labyrinthine City Hall machinations — with a reserved, perpetually-outside-looking-in independent, à la director Gus Van Sant? That feature-film odd-coupling might have understandably strained some brains in Hollywood. Making the seldom-seen moments of otherwise-secret or neglected lives visible has seemingly been Van Sant’s calling, and his most memorable films — 1985’s Mala Noche, 1989’s Drugstore Cowboy, 1991’s My Own Private Idaho, 2003’s Elephant, and even the Oscar-gathering 1997 Good Will Hunting — have relied on his coolly unblinking, surprisingly cerebral yet gently empathetic eye, whether focused on Mexican immigrants, ’70s-era oblivion-seekers, Northwestern hustlers, a hidden savant, or disaffected teenagers.

Still, those leitmotifs — entwined with Van Sant’s terrible, tangible sense of romance with his outsiders, artists, and lost souls, as well as the way his camera seems to fall head over heels for his characters — made Van Sant a natural to make Milk, after Oliver Stone’s aborted feature-film attempt to tell the slain San Francisco supervisor’s story. "There is always that question: why I haven’t done a film like this earlier," Van Sant confessed, clearing his throat for the umpteenth time while agreeing that he hasn’t ever quite done a film like Milk. "Yeah, I hadn’t done a big movie, so there were people around who were like, ‘Can you handle it? Can it be done?’ They think that way. Since there was no business model, they were like, ‘No, he can’t, because he makes these scruffy, little movies. Too big a gamble, you know.’

"That’s a part of Hollywood, but it’s kind of like safe bets: it can make bad stuff happen as easily as good stuff, and it has its own closed policies like the old conservative City Hall-type policies. ‘New supervisors who haven’t handled the job before are incapable and they’re screwing things up.’"

Thankfully the gamble paid off and the tale of California’s first openly gay politician has been told with elegance, poetry, and not a little heart-stirring, inspirational grace, by the man whom biographer James Robert Parish describes as "the standard bearer of America’s ‘queer cinema’" — one who fuses extreme close-ups, handheld shots, and found footage in a collaborative, textural approach that lends a Kodachrome pop-culty feel to his films. The process makes for "beautiful pictures every time," as a windblown Sean Penn put it at a Ritz Carlton press conference after Milk‘s Oct. 28 world premiere at the Castro Theatre.

Seated at the middle of a long table between Penn and Josh Brolin, who portrays Milk’s killer Dan White, as they traded friendly jabs, Van Sant remained mostly silent — physically at the center, but an observer apart at the same time. Later in a hotel suite, face to face with a single interviewer, the director seemed equally out of place, folded uncomfortably into a plush chair, arms tightly crossed over a tan jeans jacket sporting a "No on 8" sticker, with a small, nylon, bright-blue dollar-store-style backpack by his side. He more closely resembles a 56-year-old teacher or elder-care worker than a Hollywood insider.

The latter role is evidently still alien to him. His first brush with Milk came in 1978 while he was driving across the country and heard on the radio that the supervisor was shot. Though he later saw the 1984 documentary The Times of Harvey Milk, it never occurred to him to make a film about the politician. "It seemed like a very big story," Van Sant said. Mala Noche and Drugstore Cowboy "were stories that were devised to be made with really low budgets, like $20,000. So it was never like, ‘Oh, we can make a story about City Hall with $20,000.’ I guess I was always coming at filmmaking from not really being in the business, but knowing that I could get a hold of or save up my own money to the point where I’d have $20,000 and I could actually make a feature."

In the process of making Milk, the filmmaker admitted that he had to leave out many details that "I really like and things that sort of explain the situation. We suggest things. We explain this new law that enabled people to elect their supervisors from their districts, but we didn’t explain that the people up to that point that had to run city-wide resembled a different and maybe more antiquated type of politician. They were more, I guess, conservative. They were more business-oriented."

If San Francisco is palpable as a character in Milk, then City Hall is that elegantly shambolic figure’s brain, and Van Sant effectively used the Beaux Arts space, which harks back to classical forms, to his own dramatic ends. A down-the-rabbit-hole corridor leading to supervisors’ chambers becomes a pulsing nerve center visually rhyming with the characters’ stratagems. The sweeping staircase and balconies become the backdrop for Milk’s and White’s clashing trajectories, and the building itself becomes the spotless stage for Milk’s political birth and death.

"What I usually try and do, in general, is to connect the characters to a timeless quality, so it’s not necessarily situated in the specific time they’re in," said Van Sant. "So if they’re in City Hall and there’s a beaux-arts classical relief on the ceiling, if you frame it correctly, they can kind of look like Roman senators. You can get this timeless quality of people trading votes and betraying each other for as long as there’s been a forum and a senate.

"There were certain things in the script and in Harvey’s life — the famous line is ‘How do you like my new theater,’ which is what he says to Cleve [Jones, played by Emile Hirsch]: ‘Always take the stairs, never dress up, never blend in, make a show of it, use the whole space.’ I thought of that as a centerpiece of the whole film. That scene is one of my favorites because it was kind of like Harvey, who was a stage manager and was in theater. This was his new forum, his new theater, his new proscenium, with which to create new stuff — in this case, gay rights and other things that he thought were important, like education and help for minorities and seniors."

The question that arises so often among those who care about gay rights is: Why wasn’t Milk released before the Nov. 4 election, when it might have energized voters to shut down Proposition 8, a battle so similar to Milk’s charge against Proposition 6? As Milk screenwriter Dustin Lance Black said, "I didn’t know this [movie] would be about Prop. 8, but I don’t think this fight is over."

"I don’t really decide when movies should come out," said Van Sant. "The distributors came up with that." He spelled out some of the thoughts behind the Nov. 26 theatrical release: worries included "whether or not the elements of the story were so like the political moment that the film wouldn’t have a life after the election," and "whether people are too busy with the election to go see the movie. Are people overtaxed with politics to go see a political movie?" As a compromise, the late-October Castro Theatre premiere was arranged to get Milk and its overall message into the media eye, while still opening it into November through January, the Academy campaign season.

"Yeah, I didn’t make the call," repeats Van Sant, somewhat regretfully and shedding perhaps a smidge of that cherished detachment. "Harvey would have opened it in October."

Milk opens Wed/26 at the Castro Theatre, with additional Bay Area openings Fri/28 and Dec. 5.

The old Chris Daly line again

The Chron’s piece on the upcoming battle for board of supervisors president was fairly accurate and well-balanced, as far as it went, except for this:

the presidency appears to be guaranteed to a bloc led by the board’s most controversial member, Supervisor Chris Daly.

Daly may or may not be the board’s “most controversial member,” but he clearly isn’t the leader of the progressive bloc. He has his allies — incoming Sup John Avalos used to work for him — but the other three newcomers have other alliances. David Campos ran with the support of Tom Ammiano; Daly backed Eric Quezada. David Chiu is way closer to current Board President Aaron Peskin than to Daly. Eric Mar, former School Board member, is friendly with Daly but also with others on the board and is far too independent to just do what Daly says. And of course, Sup. Ross Mirkarimi isn’t going to follow Daly’s lead.

Daly has made it clear that he shouldn’t and won’t be board president. And with Peskin and Ammiano leaving, there’s no clear “leader” of the “progressive bloc.” That’s why the race will be so interesting.

It has been 10 days since the election and Cindy for Congress is still going strong.

I am going to start a radio show on Green 960 AM beginning November 29th at 11:30am. The brilliant part of my show is that I will be on right after Corporate Democrat, Gavin Newsom (mayor of SF). My new show is called: Cindy Sheehan’s Soap Box and we will have an amazing guest to interview each week and I will sound off on different topics: war/peace; politics; human rights; international relations; foreign policy; etc. My show will have a global/local scope to it and will also be a call to action. Also, on every show, I will answer a couple of the hundreds of emails we get every week. We will pod cast the show from our website.

The reason we are undertaking this new show, is that the corporate media (locally and nationally) wrote me off and put a blockade on coverage even before we began our campaign. When there was coverage, the writer would opine that either: a) wouldn’t get on the ballot as an independent; b) not even beat the Republican; c) not even get 10 percent. Well, friend, I a) got on the ballot (which took 10,198 signatures); b) beat the Republican by a lot and c) got almost 17% of the vote. We did far better than anyone who has ever run against Pelosi in the past and that was with very, very little media coverage. Some election night coverage only reported the stats from Nancy Pelosi and the Republican, leaving me out entirely!

So far, (still counting) we have over 45,000 votes! With your help, we were able to mount a very serious campaign that was fueled by our very progressive platform and the support of thousands of people all over the country. Thank you so much for believing in peace, accountability and true progressive values!

We are already organizing for 2010 and have kept a skeletal staff and our office to do this and we are starting a PAC (political action committee) to be able to sustain our campaign until we come out even stronger than before in 2010. We also have some campaign debt to pay off.

I truly believe with the foundation that we have built and the growing disasters that our confronting our country, (facilitated by the “leadership” of Nancy Pelosi), we have an excellent chance of taking her seat in 2010 and finally giving San Francisco a true progressive Congressional Rep. Finally, we will also be working with progressive political activists around the nation to mount challenges to every Congressperson that does not effectively represent the interests of “We the People,” and not the corporate pirates.

HARDING THEATER — LIGHTS UP ON NEXT ACT

The SF Planning Commission came through 7-0 for a full Environmental Impact Review on the Harding Theater on Thursday 11/13!

Commissioners almost universally criticized the staff recommendation for a “negative declaration” for the need for environmental review, and agreed with neighbors of the Divisadero building that there had been almost no public input.

No date was set for the beginning of hearings on the Harding, and staff said it would likely involve a hired consultant.

Community leaders who spoke included Joe Landini, Jim Bracken, Sheila Devitt, David Tornheim and more than a dozen others from the Western Addition/Panhandle/Haight neighborhoods, arguing that The Harding as a functioning arts venue will greatly enliven the Divisadero business strip, as the renovated Brava Theater Center has done for The Mission’s 24th Street.

Attorney Arthur Levy as the pro bono attorney for Friends of 1800, a non-profit preservation organization, had made the effective formal appeal on the basis that historic buildings being considered for major alterations must receive a full EIR under California law.

Prominent theater professionals and historic preservationists voiced concerns at the two hour hearing – including directors and advocates from Theater Bay Area, Lorraine Hansberry Theatre, Brava Theater, Magic Theater, Metro Theatre Center Foundation, the Garage Theater and The Independent nightclub.


Richard Reineccius was a founder of the SF Neighborhood Arts Program, and a long time advocate for arts facilities in communities. He, his ex-wife Brenda Berlin, and Doug Giebel founded the progressive Julian Theatre, performing in The Mission District and Potrero Hill from the 1960s to mid-90s.

I don’t know about you, but I could go for a party or 200 right about now. If anyone can cram the spirit of 200 parties into one night, it’s Pablo Díaz Reixa, the playfully energetic one-man force behind El Guincho. Díaz Reixa’s music thrives on contradictions, and a core one is that his bedroom project isn’t insular. Instead it’s ready to overtake the streets with carnivalesque fervor. To paraphrase a sample that rubs up against Esquivel’s zinging piano at the beginning of "Fata Morgana," all of the joy of young people in love is conveyed in the simple melodies of Alegranza! (Young Turks/XL).

Díaz Reixa has described Alegranza!‘s congotronic chant-oholic delirium as an update of space-age exotica — a restless journey that never stops at one spot on the globe. For some, such terms might set off cultural-exploitation alarms, particularly at a time when Anglo indie rock is rife with mannered, stiffly incorporated Afrobeat routines. But Díaz Reixa’s interplay of influences has an autobiographical basis. Though he was based in the Barcelona barrio Gracia when he began recording as El Guincho, he grew up in the Canary Islands, where his grandmother, a music teacher, schooled him in music. His reverence for her is similar to the admiration that minimal-techno trailblazer Ricardo Villalobos has for his distant Chilean relation, the folksinger Violeta Parra. Partly inspired by an old Catalonian folk song by Los Gofiones, El Guincho’s party is radical rather than apolitical: before adopting the El Guincho moniker, Díaz Reixa wrote a Catalan Socialist Party anthem. Alegranza! takes its title from an uninhabited land mass at the northeast tip of the Canary Islands whose name also connotes joy in Spanish. But one could just as surely locate Díaz Reixa’s sound in the air, flying like a rare bird — an eight-eyed parrot, perhaps — around the eight miles of ocean that separate the islands from Africa. As Jace Clayton points out in a recent Fader profile, the El Guincho persona allows its creator to tap into both the soulful and impish aspects of the term duende. He’s the manic musical corollary of the somnambulant Spanish filmmaker Albert Serra, whose movies — such as this year’s Canary Islands-set Christ tale Birdsong — reenvision the traditional conquistador as a (to borrow wordplay from Michael Arcega) conquistadork. He’s serious enough to not take himself too seriously: an admirer of Henri Michaux’s and Guillaume Apollinaire’s writing, he knows that only the committed will tap into the undercurrents of frustration and morbidity within his basket of cheers.

"Palmitos Park," the rollicking track that kicks off Alegranza!, was inspired by seeing a crocodile trapped in miserable conditions at a zoo. But the tension between freedom and entrapment in El Guincho’s music is sublingual. Many of his songs shift from gleeful excess into exhaustion — and then miraculously back into excitement again. This dynamic seems present in Díaz Reixa’s overall approach to music (in 2007, he recorded an album’s or CD-R’s worth of songs, titled Folías, during one high night) and to life (he had to cancel El Guincho’s first US tour due to fatigue). It’s apt that his favorite record shop is a place in Gran Canaria called Moebius, because his music is a hallucinatory Möbius strip. Mandy Parnell’s Young Turks/XL remastering of the original Discoteca Océano release of Alegranza! effectively accentuates this quality.

Now that this country is officially an Obamanation, El Guincho is ready to lead us in rambunctious chants over melding, melting 5/4 benga rhythms. Díaz Reixa’s demeanor in concert has been likened to Animal from the Muppets, but the beloved block of wood that he uses to generate organic snare sounds and electronic beats has a connection to his musical beginnings as a percussionist in a classical orchestra. El Guincho’s pet sounds are as inspiredly fantasmic as 1996-era Cornelius, and a hyper answer to the Portuguese idyll of Panda Bear’s Person Pitch (Paw Tracks, 2007). They’re as creative as the Present — meaning the band of that name that just released the superb World I See (Loaf). They’re the sound of victorious Spain today — what Rafael Nadal would listen to if he had any taste in music. (Díaz Reixa is a tennis maniac.) Díaz Reixa touts current Barcelona bands like Thelemáticos and Extraperia as often as older influences like Souley Katna because his love of music is unquestionable. It’s delirious. It’s higher than high. It’s right on time. *

SONIC REDUCER Been down so long that the initial whooping, joy-drenched Obama-phoria of Nov. 4 felt — at least before learning of Proposition 8’s passing — like that moment during the flannel-flying whirl of the early ’90s, when the world finally seemed like Kim’s playground. When everywhere I looked, ultra-cool Kims like Kim Deal, Kim Gordon, and Kim Thayil seemed to signal the primacy of the K Word. Kim was the kid with perpetual Christmas morning going on. The universe seemed to smile down on us as we made art and did what we pleased, as if to say, "Whatever, dude, I mean, Kim. It’s your day."

But what did we do with our Kimdate apart from starting clothing lines, burning out like a black hole sun, and simply keeping on? The moment passed, though it was still thrilling to finally talk to one of those crucial Ks — namely Deal, on the occasion of her surprisingly revitalized, multi-hued new Breeders album, Mountain Battles (4AD) and her forthcoming two-fer at Slim’s — and to dig her breed of Midwestern rock ‘n’ roll realness. I mean, would anyone concerned with conjuring cool or projecting power really say she was bummed out and rocking the chub duds when asked about her typical day?

"I think I’m actually a little depressed," said the sometime Pixies bassist in deliberate, Kim-to-Kim tones from Dayton, Ohio. "I’ve been sleeping in really late and I don’t know why. I gained weight — maybe because I quit smoking a year ago. I’ve gained weight, and you know, I feel fat. So that’s an odd feeling for me. I’m not very confident, and I feel kinda stupid, so I dress really bad and I just wear sweats. You know, when you’re looking good and feel good, you have a spring in your step, and then when you’re heavy for some reason, you’re just like, ‘Ah, lemme just get these sweats on and do what I have to do today.’"

Chin up, Kim — at least you have the Steve Albini-recorded Mountain Battles with insinuating, melancholy songs like the doo-wop-inflected "We’re Going to Rise" and the dreamily minimalist "Night of Joy." "Can’t stop the wave of sorrow," Deal coos in the latter alongside Deal’s twin sister Kelley, Jose Medeles, and Mando Lopez. "This night of joy follows — oh, everywhere you go." That and at least Deal has vaulted past her smoker days of getting winded after running up stairs. With the help of a prescription medication that altered her brain chemistry, she managed to kick the nic fits. "I felt a bit like a sociopath taking it for three months last year," Deal said. "Now it’s worn off and I’m just fat." She chuckled. "It’s better than being a skinny sociopath! There’s far too many of those wandering the streets right now."

But back to the average Deal day. Long after all our Kim Kristmases, Deal told me that when she isn’t touring or planning, say, the Breeders-curated May 2009 All Tomorrow’s Parties in England, she continues to spend her spare hours helping her father care for her mother, who has Alzheimer’s: "She’s doing pretty good. She knows who I am and stuff, but she can get on a loop and repeat some crazy shit! But it’s like, ‘OK, mom, whatever.’" So there is a morning after — full of earthy laughter straight from Planet Deal. *

Money is power

GREEN CITY While the latest public power proposal was soundly defeated at the polls, the apparent failure of a pair of electricity generation initiatives backed by Mayor Gavin Newsom and Pacific Gas & Electric Co. is fueling an existing plan to create more city-owned energy projects.

Proposition H, which would have moved the city toward 100 percent renewable energy by 2040 and allowed public power to help meet that goal, lost Nov. 4 by more than 20 percentage points. PG&E spent a record-breaking $10.3 million against the measure, or more than $53 per vote as of the Nov. 10 tally.

For that kind of money, said campaign finance expert Bob Stern of the Center for Government Studies, "they could have taken every voter out and bought them an expensive meal." But, he said, that’s a pittance for a company like PG&E. "They knew spending $10 million was going to save them a bunch of money."

Two days after the election, PG&E announced a 9 percent increase in year-to-date profits over last year, boosted partly by a 6 percent rate increase PG&E implemented Oct. 1, which it argued was needed to cover the increased cost of natural gas.

Prop. H would have moved San Francisco away from volatile fossil fuel prices, although the city is still hoping to procure 51 percent of its energy needs from renewables by 2017 through the community choice aggregation (CCA) program.

Meanwhile a plan to retrofit the Mirant Potrero Power Plant is looking shakier since Nov. 4, when the Board of Supervisors tabled legislation that would have authorized the Mayor’s Office and San Francisco Public Utilities Commission to negotiate the deal.

Prior Land Use and Economic Development committee hearings showed that retrofitting the plant to run on natural gas instead of diesel may not be as technologically or economically feasible as suggested in a report commissioned by Mirant (see "Power possibilities," Nov. 5).

But a recent report on CCA outlines ways the city may be able to procure the baseload energy demand required by the California Independent System Operator (Cal-ISO) without retrofitting Mirant or building new peak-demand fossil fuel plants (known as "peakers"), as city officials originally proposed.

The report by Local Power, the lead CCA consultant hired by the city, suggests that the SFPUC’s current plan to upgrade natural gas steam boilers in large downtown buildings can be modified to capture waste heat and turn it into energy, a process known as cogeneration.

The city Department of the Environment has already identified 106 MW of potential energy — about the same amount Cal-ISO is requiring the city to have on hand for energy reliability. Although this isn’t renewable energy because it’s capturing wasted gas heat, "it’s really clean, good quality brown power," said Paul Fenn of Local Power, noting that it makes use of something that is currently being wasted.

Local Power’s draft report, which lays the groundwork for what the city needs to do before 2010 to make CCA work, also disputes the conclusions of a tidal power feasibility study conducted for the SFPUC. In July, URS Corp. reported that tidal power in the Golden Gate would cost between 80 cents and $1.40 per kW-hour and only generate a little over 1 MW of power. "We do not consider a tidal power project located in the vicinity of the Golden Gate to be commercially feasible at this time," the report states.

Local Power contends that URS undervalued the potential energy by using computer modeling rather than actual tidal data and overlooked the strongest area for building an underwater turbine. It also failed to account for public financing at a lower interest rate, which would make city-owned tidal power much cheaper.

"We are confident you can get 10 MW," Fenn said. "The whole thing was modeled on PG&E ownership."

Local Power recommended the city get actual tidal data from the best spot and run the numbers again. "The ocean is the ultimate energy resource for San Francisco," said Fenn, who compared the challenge of constructing this kind of infrastructure to the Hoover Dam.

Newsom, who opposed Prop. H but still claims to support CCA, remains committed to tidal power. "Mayor Newsom supports advancing a tidal project at the mouth of the bay," his spokesperson, Joe Arellano, wrote in an e-mail.

The rollout of CCA is expected in 2010, when the city issues a request for proposals from companies interested in building or supplying energy. Several companies have already responded to a request for information. CCA is slated to include a 150 MW wind farm, 31 MW of solar, 103 MW of local distributed generation, and 107 MW of efficiency technologies. Funding would come from $1.2 billion in renewable energy bonds that have already been approved.

Local Power’s report includes concrete actions the city can take, including a plan to finally make Hetch Hetchy power available to citizens, a recommendation that the wind farm be built in the Delta for easy access to the Transbay Cable — a new 400 MW, 59-mile transmission line between Pittsburg and San Francisco that’s scheduled to be completed in 2010 — and urging the city to petition the California Public Utilities Commission (CPUC) for so-called public good charges collected from ratepayers that currently go to PG&E’s energy efficiency programs.

"We’re trying to put ideas on the table for the RFPs," said Fenn, who stressed that the city should make it as easy as possible for CCA to get underway, a goal that will require a lot more cooperation between departments. For example, the report outlines several hindrances to getting renewable energy up and running, from permit hassles to delayed interconnections to PG&E’s grid.

"Where we see problems in the city for permitting and zoning, we can seek to change them now," Fenn said.

That chance may come soon. The Land Use and Economic Development Committee is hearing legislation Nov. 12 to require conditional use permitting for all power plants greater than 10 MW. Though the legislation originally targeted the Mirant plant, the Planning Department, in its review of the draft legislation, suggested that all power plants be subject to the additional review. Sup. Aaron Peskin, who sponsored the legislation with Sup. Sophie Maxwell, suggested the change wasn’t appropriate. "It just means more public process."

But, Fenn said, "To set standards based on pre-CCA era is at this point confusing. Like [Sup.] Ross [Mirkarimi] said, the CCA program should be the unifying principle of energy policy in San Francisco. Integrating all the pieces is indeed the entire secret of making all the parts perform better so that we can achieve the required meet-or-beat-PG&E-rates outcome."

Mirkarimi told us the program could obviate retrofitting Mirant or pursuing the peakers. "CCA still has not been taken seriously enough by the SFPUC or the Newsom administration."

By midnight Nov. 4, the drama was long over: John McCain had conceded, Barack Obama had delivered his moving victory speech — declaring that “change has come to America” — and the long national nightmare of the Bush years was officially headed for the history books.

But in San Francisco, the party was just getting started.

Outside of Kilowatt, on 16th Street near Guerrero, the crowd of celebrants was dancing to the sounds of a street drummer. In the Castro District, a huge crowd was cheering and chanting Obama’s name. And on Valencia and 19th streets, a spontaneous outpouring of energy filled the intersection. Two police officers stood by watching, and when a reporter asked one if he was planning to try to shut down the celebration and clear the streets, he smiled. “Not now,” he said. “Not now.”

Then, out of nowhere, the crowd began to sing: O say can you see /By the dawn’s early light …

It was a stunning moment, as dramatic as anything we’ve seen in this city in years. In perhaps the most liberal, counterculture section of the nation’s most liberal, counterculture city, young people by the hundreds were proudly singing The Star Spangled Banner. “For the first time in my life,” one crooner announced, “I feel proud to be an American.”

Take that, Fox News. Take that Sean Hannity and Rush Limbaugh and Sarah Palin and the rest of the right-wing bigots who have tried to claim this country for themselves. On Nov. 4, 2008, progressives showed the world that we’re real Americans, too, proud of a country that has learned from its mistakes and corrected its course.

President Obama will let us down soon enough; he almost has to. The task at hand is so daunting, and our collective hopes are so high, that it’s hard to see how anyone could succeed without a few mistakes. In fact, Obama already admitted he won’t be “a perfect president.” And when you get past the rhetoric and the rock star excitement, he’s taken some pretty conservative positions on many of the big issues, from promoting “clean coal” and nuclear power to escautf8g the war in Afghanistan.

But make no mistake about it: electing Barack Obama was a progressive victory. Although he never followed the entire progressive line in his policy positions, he was, and is, the creature of a strong progressive movement that can rightly claim him as its standard-bearer. He was the candidate backed from the beginning by progressives like Supervisors Chris Daly and Ross Mirkarimi (a Green). And only after his improbable nomination did moderates like Mayor Gavin Newsom and Sen. Dianne Feinstein jump on the bandwagon.

From the start, the young, activist, left wing of the Democratic Party was the driving force behind the Obama revolution. And while he has always talked to the Washington bigwigs — and will populate his administration with many of them — he would never have won without the rest of us. And that’s a fact of political life it will be hard for him to ignore, particularly if we don’t let him forget it.

For a few generations of Americans — everyone who turned 18 after 1964 — this was the first presidential election we’ve been able to get truly excited about. It was also the first presidential election that was won, to a significant extent, on the Internet, where progressive sites like dailykos.com raised millions of dollars, generated a small army of ground troops, and drove turnout in both the primaries and the general election. The movement that was built behind Obama can become a profound and powerful force in American politics.

So this was, by any reasonable measure, the People’s Election. And now it’s the job of the people to keep that hope — and that movement — alive, even when its standard-bearer doesn’t always live up to our dreams.

The evidence that this was the People’s Election wasn’t just at the national level. It showed up in the results of the San Francisco elections as well.

This was the election that would demonstrate, for the first time since the return of district elections, whether a concerted, well-funded downtown campaign could trump a progressive grassroots organizing effort. Sure, in 2000, downtown and then-Mayor Willie Brown had their candidates, and the progressives beat them in nearly every race. But that was a time when the mayor’s popularity was in the tank, and San Franciscans of all political stripes were furious at the corruption in City Hall.

“In 2000, I think a third of the votes that the left got came from Republicans,” GOP consultant Chris Bowman, who was only partially joking, told us on election night.

This time around, with the class of 2000 termed out, a popular mayor in office and poll numbers and conventional wisdom both arguing that San Franciscans weren’t happy with the current Board of Supervisors (particularly with some of its members, most notably Chris Daly), many observers believed that a powerful big-money campaign backing some likable supervisorial candidates (with little political baggage) could dislodge the progressive majority.

As late as the week before the election, polls showed that the three swings districts — 1, 3, and 11 — were too close to call, and that in District 1, Chamber of Commerce executive Sue Lee could be heading for a victory over progressive school board member Eric Mar.

And boy, did downtown try. The big business leaders, through groups including the Committee on Jobs, the Chamber, the Association of Realtors, Plan C, the newly-formed Coalition for Responsible Growth, and the Building Owners and Managers Association, poured more than $630,000 into independent expenditures smearing progressive candidates and promoting the downtown choices. Newsom campaigned with Joe Alioto, Jr. in District 3 and Ahsha Safai in District 11. Television ads sought to link Mar, John Avalos, and David Chiu with Daly.

Although the supervisors have no role in running the schools, the Republicans and downtown pushed hard to use a measure aimed at restoring JROTC to the city’s high schools as a wedge against the progressives in the three swing districts. They also went to great lengths — even misstating the candidates’ positions — to tar Mar, Chiu, and Avalos with supporting the legalization of prostitution.

And it didn’t work.

When the votes were counted election night, it became clear that two of the three progressives — Avalos and Chiu — were headed for decisive victories. And Mar was far enough ahead that it appeared he would emerge on top.

How did that happen? Old-fashioned shoe leather. The three campaigns worked the streets hard, knocking on doors, distributing literature, and phone banking.

“I’ve been feeling pretty confident for a week,” Avalos told us election night, noting his campaign’s strong field operation. As he knocked on doors, Avalos came to understand that downtown’s attacks were ineffective: “No one bought their horseshit.”

A few weeks earlier, he hadn’t been so confident. Avalos said that Safai ran a strong, well-funded campaign and personally knocked on lots of doors in the district. But ultimately, Avalos was the candidate with the deepest roots in the district and the longest history of progressive political activism.

“This is really about our neighborhood,” Avalos told us at his election night party at Club Bottom’s Up in the Excelsior District. “It was the people in this room that really turned it around.”

The San Francisco Labor Council and the tenants’ movement also put dozens of organizers on the ground, stepping up particularly strongly as the seemingly coordinated downtown attacks persisted. “It was, quite literally, money against people, and the people won,” Labor Council director Tim Paulson told us.

Robert Haaland, a staffer with the Service Employees International Union and one of the architects of the campaign, put it more colorfully: “We ran the fucking table,” he told us election night. “It’s amazing — we were up against the biggest downtown blitz since district elections.”

The evidence suggests that this election was no anomaly: the progressive movement has taken firm hold in San Francisco, despite the tendency of the old power-brokers — from Newsom to downtown to both of the city’s corporate-owned daily newspapers — to try to marginalize it.

Political analyst David Latterman of Fall Line Analytics began the Nov. 5 presentation at the San Francisco Planning and Urban Research Association election wrap-up by displaying an ideologically-coded map of San Francisco, drawing off of data from the Progressive Voter Index that he developed with San Francisco State University political science professor Rich de Leon. The PVI is based on how San Francisco residents in different parts of the city vote on bellwether candidates and ballot measures.

“Several of the districts in San Francisco discernibly moved to the left over the last four to eight years,” Latterman told the large crowd, which was made up of many of San Francisco’s top political professionals.

The two supervisorial districts that have moved most strongly toward the progressive column in recent years were Districts 1 (the Richmond) and 11 (the Excelsior), which just happened to be two of the three swing districts (the other being District 3–North Beach and Chinatown) that were to decide the balance of power on the Board of Supervisors this election.

Latterman said Districts “1, 3, and 11 went straight progressive, and that’s just the way it is.”

In fact, in many ways, he said this was a status-quo election, with San Francisco validating the progressive-leaning board. “A lot of people in the city didn’t see it as a chance for a drastic change citywide.”

In other words, keeping progressives in City Hall has become a mainstream choice. Whatever downtown’s propaganda tried to say, most San Franciscans are happy with a district-elected board that has brought the city a living-wage law and moved it a step toward universal health insurance.

The fate of the local ballot measures was another indication that Newsom, popular as he might be, has little ability to convince the voters to accept his policy agenda.

Voters rejected efforts by Newsom to consolidate his power, rejecting his supervisorial candidates, his Community Justice Center (as presented in Measure L), and his proposed takeover of the Transportation Authority (soundly defeating Proposition P) while approving measures he opposed, including Propositions M (protecting tenants from harassment) and T (Daly’s guarantee of substance abuse treatment on demand).

Asked about it at a post-election press conference, Newsom tried to put a positive spin on the night. “Prop. A won, and I spent three years of my life on it,” he said. “Prop B. was defeated. Prop. O, I put on the ballot. I think it’s pretty small when you look at the totality of the ballot.” He pointed out that his two appointees — Carmen Chu in District 4 and Sean Elsbernd in District 7 — won handily but made no mention of his support for losing candidates Lee, Alicia Wang, Alioto, Claudine Cheng, and Safai.

“You’ve chosen two as opposed to the totality,” Newsom said of Props. L and P. “Prop. K needed to be defeated. Prop. B needed to be defeated.”

Yet Newsom personally did as little to defeat those measures as he did to support the measures he tried to claim credit for: Measures A (the General Hospital rebuild bond, which everyone supported) and revenue-producing Measures N, O, and Q. In fact, many labor and progressives leaders privately grumbled about Newsom’s absence during the campaign.

Prop. K, which would have decriminalized prostitution, was placed on the ballot by a libertarian-led signature gathering effort, not by the progressive movement. And Prop. B, the affordable housing set-aside measure sponsored by Daly, was only narrowly defeated — after a last-minute attack funded by the landlords.

All three revenue-producing measures won by wide margins. Prop. Q, the payroll tax measure, passed by one of the widest margins — 67-33.

Latterman and Alex Clemens, owner of Barbary Coast Consulting and the SF Usual Suspects Web site, were asked whether downtown might seek to repeal district elections, and both said it didn’t really matter because people seem to support the system. “I can’t imagine, short of a tragedy, district elections going anywhere,” Latterman said.

Clemens said that while downtown’s polling showed that people largely disapprove of the Board of Supervisors — just as they do most legislative bodies — people generally like their district supervisor (a reality supported by the fact that all the incumbents were reelected by sizable margins).

“It ain’t a Board of Supervisors, it is 11 supervisors,” Clemens said, noting how informed and sophisticated the San Francisco electorate is compared to many other cities. “When you try to do a broad-based attack, you frequently end up on the wrong end (of the election outcome).”

We had a bittersweet feeling watching the scene in the Castro on election night. While thousands swarmed into the streets to celebrate Obama’s election, there was no avoiding the fact that the civil-rights movement that has such deep roots in that neighborhood was facing a serious setback.

The Castro was where the late Sup. Harvey Milk started his ground-breaking campaign to stop the anti-gay Briggs Initiative in 1978. Defying the advice of the leaders of the Democratic Party, Milk took on Briggs directly, debating him all over the state and arguing against the measure that would have barred gay and lesbian people from teaching in California’s public schools.

The defeat of the Briggs Initiative was a turning point for the queer movement — and the defeat of Prop. 8, which seeks to outlaw same-sex marriage, should have been another. Just as California was the most epic battle in a nationwide campaign by right-wing bigots 30 years ago, anti-gay marriage measures have been on the ballot all over America. And if California could have rejected that tide, it might have taken the wind out of the effort.

But that wasn’t to be. Although pre-election polls showed Prop. 8 narrowly losing, it was clear by the end of election night that it was headed for victory.

Part of the reason: two religious groups, the Catholics and the Mormons, raised and spent some $25 million to pass the measure. Church-based groups mobilized a reported 100,000 grassroots volunteers to knock on doors throughout California. Yes on 8 volunteers were as visible in cities throughout California as the No on 8 volunteers were on the streets of San Francisco, presenting a popular front that the No on 8 campaign’s $35 million in spending just couldn’t counter — particularly with so many progressive activists, who otherwise would have been walking precincts to defeat Prop. 8, fanned out across the country campaigning for Obama.

“While we knew the odds for success were not with us, we believed Californians could be the first in the nation to defeat the injustice of discriminatory measures like Proposition 8,” a statement on the No on Prop. 8 Web site said. “And while victory is not ours this day, we know that because of the work done here, freedom, fairness, and equality will be ours someday. Just look at how far we have come in a few decades.”

San Francisco City Attorney Dennis Herrera, joined by Los Angeles City Attorney Rocky Delgadillo and Santa Clara County Counsel Ann C. Raven, filed a legal challenge to Prop. 8, arguing that a ballot initiative can’t be used to take away fundamental constitutional rights.

“Such a sweeping redefinition of equal protection would require a constitutional revision rather than a mere amendment,” the petition argued.

“The issue before the court today is of far greater consequence than marriage equality alone,” Herrera said. “Equal protection of the laws is not merely the cornerstone of the California Constitution, it is what separates constitutional democracy from mob rule tyranny. If allowed to stand, Prop. 8 so devastates the principle of equal protection that it endangers the fundamental rights of any potential electoral minority — even for protected classes based on race, religion, national origin, and gender.”

That may succeed. In fact, the state Supreme Court made quite clear in its analysis legalizing same-sex marriage that this was a matter of fundamental rights: “Although defendants maintain that this court has an obligation to defer to the statutory definition of marriage contained in [state law] because that statute — having been adopted through the initiative process — represents the expression of the ‘people’s will,’ this argument fails to take into account the very basic point that the provisions of the California Constitution itself constitute the ultimate expression of the people’s will, and that the fundamental rights embodied within that Constitution for the protection of all persons represent restraints that the people themselves have imposed upon the statutory enactments that may be adopted either by their elected representatives or by the voters through the initiative process.

As the United States Supreme Court explained in West Virginia State Board of Education vs. Barnette (1943) 319 U.S. 624, 638: ‘The very purpose of a Bill of Rights was to withdraw certain subjects from the vicissitudes of political controversy, to place them beyond the reach of majorities and officials and to establish them as legal principles to be applied by the courts. One’s right to life, liberty, and property, to free speech, a free press, freedom of worship and assembly, and other fundamental rights may not be submitted to vote; they depend on the outcome of no elections.'”

As Board of Supervisors President Aaron Peskin told the Guardian later that week: “Luckily, we have an independent judiciary, because the voters of California have mistakenly taken away a class of civil rights.”

But if that legal case fails, this will probably wind up on the state ballot again. And the next campaign will have to be different.

There already have been many discussions about what the No on 8 campaign did wrong and right, but it’s clear that the queer movement needs to reach out to African Americans, particularly black churches. African Americans voted heavily in favor of Prop. 8, and ministers in many congregations preached in favor of the measure.

But there are plenty of black religious leaders who took the other side. In San Francisco the Rev. Amos Brown, who leads the Third Baptist Church, one of the city’s largest African American congregations, spoke powerfully from the pulpit about the connections between the civil rights struggles of the 1960s and the fight for same-sex marriage.

The next time this is on the ballot, progressive and queer leaders will need to build a more broad-based movement. That is not only possible, but almost inevitable.

The good news — and it’s very good news — is that (as Newsom famously proclaimed) same-sex marriage is coming, whether opponents like it or not. That’s because the demographics can’t be denied: the vast majority of voters under 30 support same-sex marriage. This train is going in only one direction, and the last remaining issue is how, and when, to make the next political move.

The progressives didn’t win everything in San Francisco. Proposition H, the Clean Energy Act, was taken down by one of the most high-priced and misleading campaigns in the city’s history. Pacific Gas and Electric Co. spent more than $10 million telling lies about Prop. H, and with the daily newspapers virtually ignoring the measure and never challenging the utility’s claims, the measure went down.

“This was a big, big, big money race,” Latterman said. “In San Francisco, you spend $10 million and you’re going to beat just about anything.”

But activists aren’t giving up on pushing the city in the direction of more renewable energy (see Editorial).

Latterman said the narrow passage of Prop. V, which asked the school board to consider reinstating JROTC, wasn’t really a victory. “I would not call this a mandate. I worked with the campaign, and they weren’t looking for 53 percent. They were looking for 60-plus percent,” Latterman said. “I think you’ll see this issue just go away.”

Neither Latterman nor Clemens would speculate on who the next president of the Board of Supervisors will be, noting that there are just too many variables and options, including the possibility that a newly elected supervisor could seek that position.

At this point the obvious front-runner is Ross Mirkarimi, who not only won re-election but received more votes than any other candidate in any district. Based on results at press time, more than 23,000 people voted for Mirkarimi; Sean Elsbernd, who also had two opponents, received only about 19,000.

Mirkarimi worked hard to get Avalos, Chiu, and Mar elected, sending his own volunteers off to those districts. And with four new progressives elected to the board, joining Mirkarimi and veteran progressive Chris Daly, the progressives ought to retain the top job.

Daly tells us he won’t be a candidate — but he and Mirkarimi are not exactly close, and Daly will probably back someone else — possibly one of the newly elected supervisors.

“It’s going to be the most fascinating election that none of us will participate in,” Clemens said.

The danger, of course, is that the progressives will be unable to agree on a candidate — and a more moderate supervisor will wind up controlling committee appointments and the board agenda.

One of the most important elements of this election — and one that isn’t being discussed much — is the passage of three revenue-generating measures. Voters easily approved a higher real-estate transfer tax and a measure that closed a loophole allowing law firms and other partnerships to avoid the payroll tax. Progressives have tried to raise the transfer tax several times in the past, and have lost hard-fought campaigns.

That may mean that the anti-tax sentiment in the city has been eclipsed by the reality of the city’s devastating budget problems. And while Newsom didn’t do much to push the new tax measures, they will make his life much easier: the cuts the city will face won’t be as deep thanks to the additional $50 million or so in revenue.

It will still be a tough year for the new board. The mayor will push for cuts that the unions who supported the newly elected progressives will resist. A pivotal battle over the city’s future — the eastern neighborhoods rezoning plan — will come before the new board in the spring, when the recent arrivals will barely have had time to move into their offices.

Obama, of course, will face an even tougher spring. But progressives can at least face the future knowing that not only could it have been a lot worse; for once things might be about to get much better.

Conservative SF capitalists waste $633,000

It’ll take awhile to get a full accounting of all the money that downtown’s would-be power brokers spent in their apparently fruitless effort to buy the Board of Supervisors, but my calculation of all of their independent expenditures attacking swing district supervisorial candidates Eric Mar, David Chiu, and John Avalos — and supporting their more conservative opponents — comes to about $633,000.

We won’t know for sure whether the election day results will hold after the final absentee and provisional votes are tallied and the ranked choice voting formulas are run, which starts tomorrow, but the consensus of the political number crunchers at yesterday’s SPUR post-election event was that Mar, Chiu, and Avalos look like the winners. That means the $633,000 — which was perhaps chump change for these wealthy interest groups — succeeded only in sullying the campaign with the nastiest and most dishonest attacks of the season — and clearly identifying who’s hostile to progressives, renters, labor, and other working class San Franciscans.

Lawrence Ferlinghetti and City Lights Books

The first book I held close to my heart was Italian poet Antonio Porta’s 1987 Kisses from Another Dream, number 44 in the ongoing City Lights Pocket Poets Series. I bought it on a trip to the city from Santa Cruz when I was around 17, and I savored every line, whipping out the book at coffee shops and other high school hangouts, in attics late at night, at beach bonfires, and even for a speech at one friend’s funeral. It wasn’t just the eerily direct poems that turned me on, nor the delightful format (which has remained basically unchanged in the series aside from modernized cover designs), but a feeling of participation in a tradition that began with the first City Lights Publications book, founder Lawrence Ferlinghetti’s Pictures of the Gone World in 1955, and that has continued with wordsmiths and thinkers from Allen Ginsberg and Charles Bukowski to Tom Hayden, Terry Wolverton, and San Francisco poet laureate Jack Hirschman.

I am biased about City Lights, but isn’t that the mark of good publishers — to increase readers’ bias toward purveyors of quality writing and thought? To this end, City Lights has participated in a type of conscious branding of which Americans can be proud. The publisher and North Beach bookstore continues to be marked by fierce, heartfelt works that seem to emanate from their instantly recognizable Y-with-an-O-on-top logo of a human in a state of ecstasy, outrage, celebration, and/or soothsaying.

Having worked in numerous positions in the small press world, I continue to be annoyed by the oddly prevalent idea that putting out more books — including those of low quality which you think will sell — somehow guarantees success. Despite this type of bingeing, the information age has ushered in a new set of consumers whose interests, resources, and appetites run so wide that they crave guidance across the board. From the Slow Food movement to Bookforum.com’s daily online roundups, people are willing to research and improve most areas of their lives. Publishers have long served this need, and under the guidance of the current executive director, Elaine Katzenberger, and others such as editor and Guardian contributor Garrett Caples, co-owner Nancy Peters, and Open Media Series acquiring editor Greg Ruggiero, City Lights is increasing the potential of real and literary democracy.

At a publishing-world dinner a little while back, Katzenberger impressed me with her eloquent dedication to publishing good writing without unreasonable marketing goals. Obviously City Lights wants its books to sell, but there’s no reason to expect Oprah’s Book Club-type numbers. Part of the reason the press is still in business is that it has taken risks on good but unknown writers, not on bad but marketable mishmash. In his introduction to 1995’s City Lights Pocket Poets Anthology, Ferlinghetti writes: "The function of the independent press (besides being essentially dissident) is still to discover — to find the new voices and give voice to them — and then let the big publishers have at them." He goes on to remark that although City Lights initially tapped into the Beat scene, it has continued to respond to current circumstances: "From the beginning the aim was to publish across the board, avoiding the provincial and the academic, and not publishing (that pitfall of the little press) just our ‘gang.’ I had in mind rather an international, dissident, insurgent ferment."

In a recent column for Slate, Emily Yoffe noted that taking offense — especially taking offense at taking offense — has become a "political leitmotif" during the seemingly endless election season. Any actual discussion disappears into the mist. City Lights’ political output, whether you agree with individual authors or not, has certainly worked against the reactionary bullshit and political fluff that plagues politics everywhere. It’s been good to see them bringing this cultural literacy to more art-related titles of late, including 2007’s All Over Coffee by Paul Madonna and this year’s Shoot an Iraqi: Art, Life and Resistance Under the Gun by Wafaa Bilal and Kari Lydersen, a much-needed evaluation of Bilal’s controversial project.

One of the poems in that heart-close Porta volume is "You Continue to Ask What Silence Is." If poetry comes from silence, and politics from the space between dreams and reality, then City Lights knows what silence is, and this is why its authors scream so sweetly. A Lifetime Achievement award is as much a hymn to co-owner Ferlinghetti’s life and early organizational skills as to what City Lights has become. Though he has technically passed over the editorial reins, Ferlinghetti remains involved in the press and also, in terms of his own writing, intentionally uninvolved: he has kept New Directions, over on the other coast, as the publisher of his own writing, ensuring that in an age of celebrity and numbness, City Lights is anything but a vanity press.

Power possibilities

GREEN CITY San Francisco’s energy future is in flux. On Nov. 4, voters decided the fate of Proposition H, a plan for 100 percent renewable energy by 2040. On the same day, the Board of Supervisors was set to consider a proposal from Mayor Gavin Newsom to retrofit the 32-year-old Mirant Potrero power plant to meet a state mandate for local electricity generation.

The results of both votes occurred after the Guardian deadline, but either way, the city’s energy policy is uncertain, particularly after serious doubts about the viability of the mayor’s proposal were raised at an Oct. 22 Land Use and Economic Development Committee hearing.

The retrofit was hastily developed as an alternative to longstanding plans to replace heavily polluting units of the Mirant plant with new, cleaner, city-owned peaker plants. That plan was derailed after a meeting in May between Newsom and seven Pacific Gas and Electric Co. executives, who were apparently concerned about the city generating its own power.

The Mayor’s office calls the retrofit a "bridge" to a renewable energy future and contends it can be cheaper than and as clean as the city’s peakers. Yet at the hearing, Mike Martin, who’s evaluating the retrofit project for the San Francisco Public Utilities Commission, said no retrofits have ever reached the emissions goals cited in Newsom’s proposal.

Jeff Henderson, senior project manager for Mirant, defended the $80 million price tag for the project (which is about $30 million cheaper than the city’s plan) but also said that they were "giving a price on a project that’s never been done before." Martin said the permits alone would be twice the price stated in a Mirant-commissioned feasibility study.

Chair of the committee Sup. Sophie Maxwell, who represents the district where the plant is sited, cast cost aside, saying that human lives and the lowest possible emissions were more important to her. Her district has the highest incidences of asthma and cancer in the city.

The retrofit would still emit more nitrogen oxide, carbon monoxide, sulfur dioxide, and particulate matter than the city’s peaker plants but the Mayor’s Office is banking on it operating less, thus emitting less overall. The numbers crunched for the study by CH2M Hill presume Mirant operating about 156 hours a year, though it is permitted for 877 hours. The city has sued the company in the past for exceeding its permitted hours.

When questioned if the 97 percent emissions reduction proposed was possible, Henderson said, "The only thing that leads us to believe that is we had vendors who would say they could meet that under contract."

Maxwell invited three potential vendors to the hearing. All said the industry standard was 90 percent emissions reduction and that it was infeasible, if not technically impossible, to reach 97 percent. To try may even result in a net gain of particulate matter emissions because the plant would need more ammonia catalyst.

But the Mayor’s Office remained confident in the project. "The experts that presented before the committee were all experts attached to the CT project, so I would not consider them independent third-party experts," Newsom’s director of government affairs Nancy Kirshner-Rodriguez told the Guardian.

Bruce Schaller, vice president of Kansas-based power company Sega, said he wouldn’t bid on this job under the current parameters because, "We would be associated with a project that was a failure."

Tom Flagg, president of Equipment Source Company, said the project was "completely illogical and impossible to do." He pointed out that emissions vary widely. "You have surges in emissions levels. Sometimes it’s 94 percent, sometimes it’s 84 percent … A 97 to 98 percent reduction is impossible because in order to maintain that they have 100 percent reduction at times. It’s an average."

The need for new power generation in San Francisco has been pushed by the California Independent System Operator (Cal-ISO), but environmental groups have urged the city to challenge that mandate. Former California Public Utilities Commission president Loretta Lynch, who spoke against the retrofit plan at the hearing, told the Guardian afterward, "The ISO are ideologues, not engineers. They have no basis in fact that we need any peninsula power production."

Supervisors passed a resolution asking the SFPUC to develop a transmission-only plan to meet Cal-ISO’s reliability demands. The SFPUC said it will present something within the next couple of months.

Alice Russell

PREVIEW When I see the name Alice Russell, I think first of Alice Coltrane and Arthur Russell before I think of this Brighton, UK, blue-eyed soul revivalist. And I’m aware that this may unfairly predispose me to her music, which is not without its charms.

The two other major UK soul vocalists to make an impact stateside, Lily Allen and Amy Winehouse, arrived as self-generating publicity machines whose public images matched their respective styles. In contrast, Russell’s music is up without being overtly rebellious. The posturing’s explicitly enthusiastic, without the attack of Winehouse or the reggae-pop concision of Allen, on Russell’s fourth LP, and first bid for a wider audience, Pot of Gold (Six Degrees/Little Poppet), which are at their best and most unique on songs like "Let Us Be Loving," which stitches together a dubby, tumbling rhythm and gives Russell some space disco ethereality.

But the album also has moments of superfluity. I don’t get the sense that Russell felt compelled to cover Gnarls Barkley’s "Crazy" because she could coax some radical reading of it. Instead, it’s plunked down in the disc’s otherwise-decent closing stretch, as if another anchor wouldn’t do a better job of giving listeners a sense of how Russell stands apart from the nu-soul pack. In this light, it’s hard not to see nu-soul as a rockist backlash against the perceived inauthenticity of nu-rave, which ultimately isn’t inauthentic enough to bother anyone.

The United States of America and the Planet are teetering on the edge of economic and environmental collapse. We are now well aware of the threat of global warming and the catastrophic climate change it is causing. We know we have to curtail greenhouse gas emissions to heal the planet and sustain life on Earth. We are also in the midst of a serious financial crisis the depths of which we are coming to understand more and more as the days go by. But the economic instability we are experiencing is not just a result of toxic mortgage backed securities and the credit crunch. It’s not just the folly of Wall Street, it’s the folly of Big Oil, it’s the folly of our energy policy, and it is the folly of war.

We borrow trillions of dollars, mainly from China, to violently secure fossil fuel energy resources in the Middle East. This is not only environmentally unsustainable, it is economically unsustainable. Our current energy consumption and geo-political existence are destroying the planet and the American economy.
We are actually amazingly fortunate that there is one answer to our biggest problems. Clean Energy. We cannot save the planet from environmental disaster without developing clean and renewable sources of energy and we cannot save our economy in the long-term without becoming energy independent. Building a massive renewable energy infrastructure will heal the planet, stabilize the economy, create jobs, lift people out of poverty, and relieve us from war.

Our generation has a responsibility to figure this out now. San Francisco has the immediate opportunity with Proposition H to lead the world in the fight against global warming and lead the nation in the quest for energy independence.
Let’s not underestimate what one city can do. San Francisco has been out in front on so many issues in the past, from gay marriage to the most progressive minimum wage in the country. Two years ago a bunch of young workers in San Francisco past a paid sick days measure and now Barack Obama is talking about implementing it nationally. Just a few months ago a rag tag group of San Francisco activists put a 100% Clean Energy initiative on the ballot. A few weeks later, Al Gore issued his now famous energy challenge to America. If San Francisco passes Prop H, other cities and other states and countries around the world will follow.

We now face the biggest economic crisis since the great depression. It has become glaringly apparent that the free market and unregulated rule by private profiteering financial institutions and corporations is not a model that will sustain a healthy economy in this country. Wall Street’s greed has been matched only by Big Oil companies that have made windfall profits while moving at a snail’s pace towards developing alternative energy sources. In San Francisco, financial mismanagement of the private-investor owned utility PG&E has left us with skyrocketing electric rates for natural gas and a paltry supply of renewable energy. It’s time for the public accountability and stewardship of our energy resources and infrastructure that we will get with Proposition H.

At this pivotal moment in history we are faced with profound choices about our place in the world and our future on the planet. We can continue with the folly of national debt, oil profiteering and war or we can create a new clean energy economy, a fearless new ‘new deal’ that builds the next great public works projects, employs the next generation of workers, and ensures peace and stability in the 21st century. With Proposition H, San Francisco will be ready to work with the next President and the federal government to lead the clean energy revolution and build the renewable energy infrastructure that we need to sustain life on earth.

SONIC REDUCER Zut alors, where is the joie, mademoiselles? Judging from the current pop charts, rage is all the rage: girls just want to "start a fight" is the message from Pink, Brit, and Katy Perry, even as pop’s queen Beyoncé, a.k.a., Sasha Fierce, chooses the somber rather than ferocious path with "If I Were a Boy."

Maybe it’s too much to ask for a recession-wracked America to find a battered vein of real happiness. And perhaps that’s why I’m looking for bliss overseas. You have to be a crusty old croissant to not succumb to the wholesomely sexy, gallic-girls-just-want-to-have-fun charm of Yelle, née Julie Budet. In a year when every pop thang coming out of Francophone music-makers seems to exude a freshness that escapes rage-aholic American pop, along comes Yelle with the cutest bob this side of Rihanna and those prep-cool dancing boys in "A Cause Des Garçons." Not for nothing does Budet’s acronym nom de plume stand for "You Enjoy Life." Could this be the new yé-yé?

Resembling a sprightly Feist onstage, the jeune fille also coughed up the catchiest bit of whistle(-along) bait since Peter Bjorn and John’s "Young Folks": "Ce Jeu." Yelle’s palpable ’80s-throwback aesthetic crossed with the twirly-girly, smiley-faced nouveau-rave dancefloor vibe in the "Je Veux Te Voir" video — squeaky-cute aerobics, girl-gang dance moves, and a crayon-bright pop aesthetic, oo-la-la — evokes the seemingly last microsecond of dance-pop innocence when Her Madgesty, Salt-N-Pepa, and J.J. Fad ruled the school canteen. Who needs to speak the language when confronted with the inexorable, happy-sad-but-mostly-happy sizzle of "Tristesse/Joie," given a Reebok commercial makeover this past summer?

So why France and why now? According to Budet, "maybe because France is well-located between English pop, German electro, and American production! It’s geography!"

Mais oui, Budet enjoys life — and exclamation points! Though our trans-Atlantic phone tête-à-tête didn’t materialize, I managed to connect via e-mail with the Bretagne-born vocalist, who’s more comfortable answering questions in writing when she isn’t slinking around onstage like a T-shirted electro-pop whippet. Of course, she isn’t quite as wholesome as she might appear: her first MySpace hit — "Short Dick Cuizi," a poke at Cuizinier of French hip-hop group TTC and an early incarnation of "Je Veux Te Voir," famously samples the bassline of "Short Dick Man." "The songs are about our lives and our productions," she writes. "I think about everything in Pop Up [her new debut on Source Etc/Caroline/EMI]: dildos, but death, too."

Some fans might be taken aback by Budet’s live appearances, which are low on the diva-esque antics and high on the every-girl bounce. "We naturally worked hard on our show," she writes, predicting ghosts onstage for her Halloween appearance. "It’s normal for us to give a real show, not only the songs like on the album. Drums bring a lot of energy, and we build our live set like a DJ set, mixing the songs together, adding production. We have a compromise that seems to work: we rock the dancers and we dance the rockers!" So get your fill of Yelle because 2009 will be "the year of the break," Budet suspects. "We have to take time at home or people are gonna hate us, ahah!"

It’s not the invisible hand of Adam Smith tossing hate mail on your doorstep this fall like ugly confetti. It isn’t a distinct and independent group of candidates and civic organizations that just happen to be saying the same things, either. There is a carefully orchestrated campaign going on to undermine the progressive agenda, block affordable housing and clean energy, and give Mayor Gavin Newsom a majority on the Board of Supervisors.

It’s well funded; it’s serious; it’s based on lies — and it’s a threat to rent control, sustainable environmental policies, universal health care, the city’s living wage law, and the rest of the accomplishments and goals of the progressive majority on the board.

If that sounds overblown, listen to what the organizers of this campaign are saying themselves.

On Aug. 15, after progressives took control of the Democratic County Central Committee and installed Sup. Aaron Peskin as chair, John Keogan, the head of a year-old organization called the San Francisco Coalition for Responsible Growth, a pro-downtown group founded to counter the progressive movement, announced his intentions in a letter to allies.

"CRG are [sic] preparing for an all-out attack with other like-minded groups and now is our time to stand-up [sic] and be counted," Keogan wrote. He asked members to support "taking SF on a sharp turn to the right."

Those "other like-minded groups," according to campaign finance reports, are a Who’s Who list of downtown-based organizations that have consistently fought to roll back tenant protections and slash government spending on social services: the Building Owners and Managers Association, the Committee on Jobs, Pacific Gas and Electric Co., the Association of Realtors, the Chamber of Commerce, Plan C, and the Police Officers Association.

By law, political candidates can only raise and spend limited amounts of money. But organizations like BOMA, the Realtors, and Plan C can put as much cash as they want into supporting and opposing candidates — as long as the efforts are "independent."

But the orchestration of the attacks on supervisorial candidates Eric Mar, John Avalos, and David Chiu, and the support for their conservative rivals, Sue Lee, Ahsha Safai, and Joe Alioto, is so sophisticated it’s impossible to believe that these groups and candidates aren’t working together.

Between Sept. 9 and Oct. 20, public records show, the groups spent a combined $363,754 ($178,177 in District 1, $104,308 in D3, and $81,269 in D11) on independent expenditures attacking Avalos, Mar, and Chiu and supporting their opponents. They also spent $20,000 supporting Eva Royale in her long shot race for the solidly progressive District 9 seat.

The landlords and downtown aren’t the only ones organizing. All that spending, and the threat of even more to come considering the hundreds of thousands of dollars these downtown groups still have in the bank, has served to unite tenant and labor groups in ways unseen in previous San Francisco elections.

"There’s an unprecedented coalition between tenants and labor," labor activist Robert Haaland told us. "We’re working together to defeat the landlord candidates, who are also anti-labor."

"We have a tremendous fear that the spending and progress on health care and social services will be rolled back," Tim Paulson, president of the San Francisco Labor Council, told us. "Anything less than our candidates [being elected in each of the three swing districts] will pose a real danger to the movement."

NEWSOM’S SLATE


One of the central players in this attempt to take the city away from the progressives and hand it over to downtown is Mayor Gavin Newsom, who is actively supporting Alioto, Lee, and Safai.

Eric Jaye, the mayor’s chief political advisor, has no formal role in the three district campaigns, but Newsom rarely makes a move in local politics without consulting Jaye. In fact, when reporters call the mayor’s press office to ask for comments on local candidates and initiatives, they are typically referred to the private consultant.

Jaye told us he’s talked to all of Newsom’s candidates. "I told them to run on district issues," he said.

The mayor and the latest member of the Alioto clan to seek office (Joe’s sister, Michela, is already on the board) have walked precincts together. And Newsom is so involved with the downtown effort he’s skipping a major Democratic Party gala (where he was slated to get an award) to spend time instead with the Republican-led Coalition for Responsible Growth (CRG).

Jaye’s main job this fall is running the PG&E campaign against the Clean Energy Act, Proposition H. So far PG&E has spent more than $10 million on the effort, and that number will grow in the final week before the election. Part of that same campaign has been propping up Newsom ally Carmen Chu, who has benefited from thousands of dollars of PG&E spending on her race. Chu’s face is all over PG&E’s No on H fliers.

Another central operator is Alex Tourk, the former Newsom aide who resigned after learning that the mayor had been sexually involved with Tourk’s wife. Tourk is now running the CRG operation.

"They brought me on board to do a volunteer campaign that, yes, they funded, but which seeks to inform voters in a non-partisan fashion where the candidates in D1, 3, and 11 stand on key issues," he said.

That campaign’s goal was to get 10,000 people to mobilize — he called them, using a term popularized by Richard Nixon, the "silent majority."

Tourk maintains that door-hangers the group has been distributing don’t endorse any candidates or push any initiatives. But the messages fit exactly with the overall downtown strategy — they seek to discredit the progressives by linking them with controversial ballot measures such as Proposition V, which would urge the School Board to save the military recruitment program, JROTC.

The supervisors have nothing to do with JROTC, but downtown and the Republican Party are using it as a wedge issue.

CRG is facing some political heat of its own: SF Weekly reported in its Oct. 22 issue that CRG’s recently elected president, engineer Rodrigo Santos, accepted money for professional work from someone who had business before the Building Inspection Commission while he served as commission president. Santos is a Republican, like several key Newsom appointees.

Making matters worse are revelations that Mel Murphy, vice president of the inspection commission and a CRG member, distributed invites in City Hall to an Oct. 17 CRG fundraiser for Safai and Alioto. City officials aren’t supposed to do political work at City Hall.

Alioto’s filings show that on Oct. 17, he received $500 from the firm of Santos and Urrutia’s structural engineer Kelton Finney and $250 from S&U engineer Calvin Hom.

PG&E’S FAKE DEMOCRATIC CLUBS


Political consultants Tom Hsieh Jr. and Jim Ross are involved in the District 1 race (Hsieh also responded to the Guardian on Safai’s behalf) — and are using PG&E and downtown money to support Sue Lee.

Beyond Chron reported Oct. 27 that Hsieh has been sending robocalls in Cantonese to voters saying that Lee is endorsed by the "San Francisco Democratic Party Club." Actually, the Democratic Party endorsed Mar.

What is this new "party club" anyway? Well, the Web site reported, the club started raising money just two weeks ago, and already has collected $30,000 from PG&E, $2,000 from the Chamber of Commerce, $5,000 from GGRA (Golden Gate Restaurant Association), and $70,000 from the Committee on Jobs. Another new club, called the Richmond Reform Democratic Club, is opposing Mar — and has $18,000 from the Committee on Jobs, $5,000 from PG&E, and $2,000 from BOMA.

In television ads paid for by the Realtors, a voiceover tries to link Mar, Avalos, and Chiu to Sup. Chris Daly, whose popularity outside his district is low — although neither Mar nor Chiu has much of a discernable connection to Daly. Avalos was a Daly City Hall aide.

One of the Realtors ads was so utterly inaccurate and deceptive — it claimed Chiu and Avalos support decriminalizing prostitution, when both have publicly opposed the decriminalization ballot measure — that Comcast pulled the ad off the air when Chiu filed a complaint.

Fog City Journal uncovered what appears to be illegal collusion between the police union and Safai. Although candidates are barred from coordinating with groups making independent expenditures on their behalf, POA president Gary Delagnes told FCJ editor Luke Thomas that Safai had given the group a photo of him to use on a mailer, a copyrighted image that Thomas took. Safai denied wrongdoing, but refused to answer further inquiries about the matter.

It’s a pitched battle — labor, the tenants, and the Democratic Party against the landlords, PG&E, downtown interests, and the Republicans. It’s pretty clear which side you want to be on.

The battle for the district 1 supervisor’s seat is being framed largely by politically conservative groups, funded by real estate and development, that are spending thousands of dollars supporting former planning commissioner Sue Lee over school board member Eric Mar.

An incestuous web of independent expenditure and political action committees have collectively spent enough against Mar to blow the $140,000 cap off the voluntary expenditure ceiling that all the candidates in that district agreed to.

The money’s coming from the Building Owners and Managers Association, Plan C, the Coalition for Responsible Growth, and the San Francisco Association of Realtors. Although these groups can’t legally work directly with candidates, they typically swap funds among each other and receive outside support from the deep pockets at the Chamber of Commerce, Committee on Jobs, and Pacific Gas and Electric Co.

According to Ethics Commission executive director John St. Croix, the $140,000 cap was lifted on Friday, Oct. 24, which means the candidates are now free to spend up to their individual campaign limits, which are different for Lee, Mar, and Alicia Wang, the other major contender for the seat.

All three are receiving public financing — but so much outside money is being spent in support of Lee that, to keep pace, the individual spending caps for Mar and Wang have been raised and are now higher than Lee’s.

AGAINST THE NEIGHBORHOODS


Lee, who worked for Willie Brown’s mayoral administration and was public relations director for the Chamber of Commerce, now runs the Chinese Historical Society of America. Her voting record on the Planning Commission has been consistently pro-development and anti-neighborhood. Some examples from her final months on the commission:

<\!s> On April 10, 2008, she approved a mixed-use development at 736 Valencia St. and removed community benefits and below-market-rate unit requirements — against the wishes of community members and housing rights activists.

<\!s> On March 27, 2008, she was the only commissioner to vote against modifications to a rooftop remodeling project at 1420 Montgomery St. that would have pacified neighbors concerned about the scale and character of the plan.

<\!s> On March 13, 2008 she supported a conditional-use permit for a formula-retail paint store at Cesar Chavez and South Van Ness despite concerns about its effect on nearby small businesses.

<\!s> On Feb. 28, 2008, she approved a remodeling of a two-story flat on Potrero Ave. that opponents, including the next-door neighbors, characterized as a demolition in disguise.

"Her voting record for the past three years is crystal clear," one lawyer who represents neighborhood interests at the commission told us. "Given a choice between supporting neighborhood interests, long-term residents and the interests of the little guy or supporting development interests and the big- money people who are busy in our residential neighborhoods, she chooses the latter every time."

The lawyer, who regularly appears before the planning panel and asked not to be named, added: "She has supported big-box retail in our neighborhoods over the objections of neighbors. She has supported the destruction of rent-controlled housing and low-scale, more affordable housing that is being remodeled out of existence."

"She’s a total pay to play," said Robert Haaland, a labor activist with Service Employees International Union Local 1021, which is deeply vested in independent expenditures supporting Mar. "Her donations can be tracked back to decisions she made as planning commissioner."

For example, Lee voted in favor of a plan by Martin Building Company to convert a city-owned building on Jessie Street into 25 luxury condos that now rent for about $3,000 a month. Martin’s owner, Patrick McNerney is a Lee campaign donor. Also contributing to Lee is Eric Tao of AGI Capital, which helped finance the Soma Grand development, a project opposed by sustainable growth organizations like Livable City, the San Francisco Bicycle Coalition, Walk SF, and the Sierra Club. Lee voted in favor of it.

In 2006, Lee approved lifting the downtown height restrictions from 150 feet to 250 feet for a 189-unit building with ground level retail on Howard Street. The project sponsor, Ezra Mercy, gave Lee’s campaign the maximum legal donation of $500.

In fact, her campaign has received thousands of dollars in individual contributions — and according to our analysis, more than half has come from real estate developers, attorneys, and builders, including some who appear frequently before the Planning Commission, such as executives from Wilson Meany Sullivan, CB Richard Ellis, and Millennium Partners.

Lee did not return a call seeking comment.

MISLEADING THE VOTERS


The same day the spending cap was lifted, Mar alleged the local Democratic Party’s name was being improperly used by a new group calling itself the "San Francisco Democratic Club." First reported by Paul Hogarth on the online news site BeyondChron, the club is apparently composed of Democratic County Central Committee defectors who disagreed with the party’s endorsements for the Nov. 4 election.

The group’s treasurer, Mike Riordan, is also a deputy political director of PG&E’s Stop the Blank Check Committee, which is mounting the $10 million campaign against the Clean Energy Act. PG&E gave $30,000 to this new democratic club, the members of which have not been revealed.

Riordan hired DCCC member Tom Hseih’s firm to send robocalls in Cantonese to Asian voters urging support for Lee over DCCC-endorsed Mar. The endorsement script referred to the group as the "San Francisco Democratic Party Club." Mar said it was a misleading way to align this new club with the DCCC.

When asked if the club’s use of the Democratic Party name and membership to support candidates and issues that haven’t received the party’s vote was their intention, Hsieh told the Guardian, "Yeah, and you know what? That’s covered under the First Amendment."

Sup. Aaron Peskin, who chairs the DCCC and spoke on its behalf in support of Mar at two recent rallies, said, "at minimum, it’s misleading. At maximum it’s a violation of the party rules and punishable by removal." He said there was a credible argument and evidence supporting Mar’s allegation, but that it’s something the DCCC would have to deal with in its own house, likely after Nov. 4.

Voting to save the local economy

EDITORIAL On Oct. 21, a string of economists and advisors from the Newsom administration, the Chamber of Commerce, and the Convention and Visitors Bureau appeared before the San Francisco Board of Supervisors to present a picture of the local economy that was stunning in its lack of reality.

The experts talked about how San Francisco isn’t really hurting that much right now. They said the downturn would hit eventually, but that housing and jobs are still relatively strong here. And what we need to do to boost the economy, the mayor and his experts said, is to promote downtown business, cut fees — and further reduce the city budget.

Cut taxes? Cut spending? Boost big business? That sounds a lot like the economic prescriptions we’ve been hearing from the right wing of the Republican Party for decades. And it hasn’t exactly worked out well.

In fact, for many San Franciscans, the recession is already here — and is deep and painful. Small businesses are struggling. People are losing jobs and finding it hard to pay the rent. Like Washington, DC, San Francisco needs to be taking this seriously — but what we’ve seen from Mayor Gavin Newsom is a bunch of hot air. The mayor wants to accelerate capital spending. Fine. But he’s counting on projects like rebuilding Airport Terminal Two that rely on bond sales — and this isn’t a great time to be selling bonds — and that create jobs mostly for big out-of-town construction firms. And he wants to cut fees on business — which has never proven to be an economic stimulus, but would require deeper cuts in city programs and layoffs of city staffers. The worst thing you can do in a recession is cut public jobs.

At the Oct. 21 hearing, the supervisors were a bit dubious. "We need to be straightforward and real," said Board President Aaron Peskin. "Not half-baked schemes and empty promises." But if Newsom and his downtown and landlord allies get their way, the board that takes office in January could be very different. The progressives who have held the line on cuts, pushed for higher taxes on the wealthy, and promoted measures that will actually help the economy could wind up in the minority. And we could see a dramatic shift to the right in economic policy.

The November election is critical — and the top of the ticket isn’t the only vote that matters. Preserving the progressive majority on the board and passing the key ballot measures will take the city a long way toward avoiding the worst of what could be a catastrophic economic downturn.

Let’s look at the ballot from that perspective:

<\!s> Proposition H would inject millions into the economy. San Francisco residents and businesses pay some of the highest electric rates in the country, and money that goes to Pacific Gas and Electric Co. is sucked right out of town and invested elsewhere. Since electricity is a necessity, cutting electric rates would instantly inject cash into the economy. In fact, a 2002 study by Hofstra University economist Irwin Kellner showed that public power expanded the economy of Long Island. by $10 billion over the first four years after that region got rid of its private electric utility.

Based on his methodology and calculations, we estimated in 2002 that PG&E cost the local economy $620 million over the previous two years (see "The $620 million shakedown," 10/4/02). Updating those figures today shows a dramatic impact: In the past decade, PG&E rate hikes have taken 1.015 billion out of the local economy. And if, as we have estimated, a public power agency could cut rates by 15 percent, that would inject $477 million a year into the local economy (see sfbg.com for a detailed calculation). That’s a lot more money than the city would see from any of Newsom’s proposals.

Proposition B would create thousands of new jobs. Building a new terminal at the airport attracts big national construction companies. Affordable housing in a much more home-grown operation. The nonprofits that build below-market housing in San Francisco hire local construction workers, at union scale; that money stays in the economy. Affordable housing also helps stabilize and upgrade neighborhoods, adding small business and cultural institutions that create more jobs and economic impact. "It’s a monster source of jobs," Rene Cazenave, who is working on the Yes on B campaign, told us. In fact, Prop. B alone would create a lot more jobs than the mayor’s entire economic stimulus plan.

Propositions N, O and Q would save jobs. As the city’s budget deficit continues to grow, Newsom is talking about cutting more services — and that means cutting public sector jobs. Many of those workers live in San Francisco; eliminating jobs hurts the local economy. Prop. O would prevent the city from losing $80 million in tax revenue every year; Props. N and Q would bring in millions more. That would save jobs and help stave off a deeper recession.

Preserving an independent board will keep Newsom’s worst economic policies in check. If supervisorial candidates Sue Lee, Joe Alioto, and Ahsha Safai win in Districts 1, 3 and 11, Newsom will have a loyal majority — and the city’s economy will be in trouble. The mayor of San Francisco is a Democrat, but his economic policies are much closer to what John McCain is proposing — and they won’t work. San Francisco needs a strong independent board to keep asking the tough questions and demanding alternatives. It’s critical to elect Eric Mar, David Chiu, and John Avalos in those swing districts.

There’s so much at stake in this election. Vote early, vote often, and vote all the way to the bottom of the ballot.

The stealth candidate

Ahsha Safai is hoping to be elected to the Board of Supervisors without answering questions about his padded political resume of short-lived patronage jobs, greatly exaggerated claims of his accomplishments, history as a predatory real estate speculator, connections to and coordination with downtown power brokers, shifting and contradictory policy positions, or the many other distortions this political neophyte is offering up to voters in District 11, a crucial swing district that could decide the balance of power in city government.

Safai has refused numerous requests for interviews with the Guardian over the last two months. We’ve even left messages with specific concerns about his record and positions. But our investigation reveals his close political ties to the downtown interest groups that have spent close to $100,000 on his behalf and shows him to be a shameless opportunist who is apparently willing to say anything to achieve power.

There’s much we don’t know about Ahsha Safai, but there’s enough we do know for a consistent yet troubling portrait to emerge.

Safai moved to San Francisco from Washington, DC with his lawyer wife in 2000, and immediately began to ingratiate himself into the mainstream Democratic Party power structure, starting as a legislative liaison with the corruption-plagued San Francisco Housing Authority and joining Gavin Newsom’s mayoral campaign in 2003.

Safai became a protégé of Newsom’s field director Alex Tourk, who was a top Newsom strategist for several years until he abruptly resigned after learning that Newsom had an affair with his wife. With support from Tourk (who didn’t respond to our calls about Safai) and Newsom, Safai held a string of city jobs over the next three years, moving from the Mayor’s Office of Community Development to the Mayor’s Office of Neighborhood Services to the Department of Public Works, all of which he touts on his Web ite, greatly exaggerating (and in some cases, outright misrepresenting) his accomplishments in each, according to those who worked with him. (Few sources who worked with Safai would speak on the record, fearing repercussions from Newsom).

THE CONNECT DISASTER


One project Safai doesn’t mention on his Web site is his work spearheading Community Connect, the most disastrous of Newsom’s SF Connect programs. "It’s the one Connect that the mayor will never talk about," said Quentin Mecke, who participated in the effort, on behalf of nonprofit groups, to create a community policing system. "The whole thing just devolved into chaos and there weren’t any more meetings."

In 2005, Safai and Tourk convened meetings in each of the city’s police precincts to take testimony on rising violence and the failure of the San Francisco Police Department to deal with it. Ultimately Newsom decided to reject a community-policing plan developed through the process by the African-American Police Community Relations Board. That set up the Board of Supervisors to successfully override a mayoral veto of police foot patrols.

"Ahsha’s approach was consistent with the Newsom administration, with folks that talk a good game but there’s no substance behind it," said Mecke, who ran for mayor last year, placing second.

Another realm in which Safai has claimed undeserved credit is on his efforts to save St. Luke’s Hospital from attempts by the California Pacific Medical Center (and CPMC’s parent company, Sutter Health) to close it or scale back its role as an acute care provider for low income San Franciscans.

"When I looked at his campaign material and he says he was a leader who saved St. Luke’s, I thought, ‘Am I missing something here?," Roma Guy, a 12-year member of the city’s Health Commission and leader in the effort to save St. Luke’s, told the Guardian. "Nobody thinks Ahsha has taken a leadership role on this. This is a significant exaggeration from where I sit."

Nato Green, who represents nurses at St. Luke’s within the California Nurses Association, went even further than Guy, saying he was worried about Safai’s late arrival to the issue (Safai wasn’t part of the group that protested, organized, and urged CPMC to agree to rebuild the hospital) and the fact that CPMC appointed Safai to its Community Outreach Task Force as the representative from Distrist 11.

"From our point of view, he is the CPMC’s AstroTurf program, simuutf8g community participation," Green told us. "It’s critical to us that we end up with a supervisor who is independent of CPMC and will go to the mat for what the community needs."

CNA has endorsed Avalos in the District 11 race.

"John was the only candidate in District 11 who came out and spoke at the hearings, attended the vigils, and walked the picket line during the strikes," Green said.


REAL ESTATE SPECULATION


Beyond his association with downtown power brokers and endorsement by Newsom, there are other indicators that Safai is hostile to progressive values. He said in a recent televised forum that he would work most closely with supervisors Carmen Chu, Sean Elsbernd, and Michela Alioto-Pier, the three most conservative members of the Board of Supervisors.

During an Oct. 14 Avalos fundraiser hosted by sustainable transportation advocates Dave Snyder, Tom Radulovich, and Leah Shahum, attendees expressed frustration at Safai’s tendency to pander to groups like the San Francisco Bicycle Coalition, taking whatever position he thinks they want to hear without considering their implications or consistency with his other stands.

"It was a no-brainer for the Bike Coalition to endorse John," Shahum, SFBC’s executive director, said at the event, noting Avalos’ long history of support for alternatives to the automobile.

Avalos, who had been hammered all week by mailers and robocalls from downtown groups supporting Safai, said he was frustrated by the barrage but that "we can fight the money with people.

"Ahsha has done everything he can to blur the lines about what he stands for," Avalos said. "Whoever he’s talking to, that’s who he’s going to be. But we need principled leadership in San Francisco."

One area where Safai doesn’t appear to be proud of his work is in real estate, opting to be identified on voting materials as a "nonprofit education advisor." One of his opponents, Julio Ramos, formally challenged the designation, writing to the Election Department that the label "would mislead voters and is not factually accurate, the term ‘businessman’ or ‘investor’ denotes the true livelihood of candidate Safai."

Safai responded by defending the title and writing, "My dates of employment at Mission Language Vocational School were from August 2007 through February 2008." So, because of his seven-month stint at this nonprofit, voters will see Safai as someone who works in education, even though his financial disclosure forms show that most of his six-figure income comes from Blankshore LLC, a Los Altos-based developer currently building a large condo project at 2189 Bayshore Blvd. that is worth more than $1 million. (That’s the top value bracket listed on the form, so we don’t know how many millions the project is actually worth or how much more than $100,000 Safai earned this year).

But we do know from city records that Safai has personally bought at least three properties during his short stint in San Francisco, including one at 78 Latona Street that he flipped for a huge profit after buying it from a woman facing foreclosure, who then sued Safai for fraud.

The woman, Mary McDowell, alleged in court documents that real estate broker Harold Smith, "unsolicited, came to plaintiff’s residence and offered assistance to her because her homes were in foreclosure … [and said] she would receive sufficient money after sales commissions to reinstate the loans on the four other properties."

The legal complaint said Smith then modified those terms to pay McDowell less than promised and arranged to sell the home to Safai and his brother, Reza. "Plaintiff is informed and believes and thereon alleges that defendants did not promptly list her residence on the multiple listing service to avoid larger offers on the home and conspired with the other defendants to purchase the home at a far less than market price," reads the complaint.

The case was originally set for jury trial, indicating it had some merit. But after numerous pleadings and procedural actions that resulted in the plaintiff’s attorney being sanctioned for failing to meet certain court deadlines and demands, the case was dismissed.
But whatever the merit to the case, records on file with the county assessor and recorder show that Safai and his brother flipped the property for a tidy profit. They paid $365,500 for the place in December 2003 — and sold it two year later, in December 2005, for $800,000.
Labor activist Robert Haaland told us that Safai can’t be trusted to support rent control or the rights of workers or tenants: "At the end of the day, he’s a real estate speculator."
