The Bush administration plans to increase quota of Iraqi refugees allowed into the U.S. from 500 to 7,000 next year in response to the growing refugee crisis, according to the Guardian Unlimited.

Border policies are tightening because one million Iraqi refugees have already fled to Jordan and another one million to Syria. Iraqi refugees who manage to make it out of Iraq still can’t work, have difficulty attending school and are not eligible for health care. Many still need to return to Iraq to escape poverty, according to BBC news.

After maintaining it on their own for the first year, they gave it to the National Priorities Project to contribute to their ongoing educational efforts.

Iron curtain in outer space

Throughout its history, the Soviet Union felt like the final frontier to many Americans. What was happening on the other side of that iron curtain? The Russians wondered too. Since travel between the countries was so limited, their inhabitants often had to turn for information to the cultural products that made it — both ways — past Russia’s gatekeepers. How better to hide meaning than in fairy tales and outer space? The Pacific Film Archive celebrates an age of anxiety and this age of information with its marvelous series "From the Stars to the Tsars: A Journey Through Russian Fantastik Cinema."

The films of "From the Stars to the Tsars" span the period from the 1912 short The Cameraman’s Revenge and Aelita, Queen of Mars — the 1924 silent classic that inspired Guy Maddin’s The Heart of the World — to 2005’s First on the Moon. The series’s other notable traversal is between high and low culture. Some entries were partly seen at drive-ins in the 1960s thanks to Roger Corman, who bought the rights to The Heavens Call (1959) and Planet of Storms (1961) and scavenged their footage; To the Stars by Hard Ways (1982; reedited 2001) made an appearance as Humanoid Woman on Mystery Science Theater 3000. Then there are the films more familiar to art house patrons; the two by Andrei Tarkovsky, 1972’s Solaris and 1979’s Stalker, cemented his reputation, and the former was hailed as the Soviet response to 2001: A Space Odyssey. The rest of the series falls between these poles. Although their politics and plots vary, all the films share a joy in the medium’s magic and an affinity for dazzling and provocative visual effects, whether they be ridiculous, sublime (the signal that Stalker‘s mysterious Zone is ready for its visitors is a marvel of quiet beauty), or both.

Another obvious draw is these films’ Russian-ness. Ruslan and Ludmila (1972) is based on an Aleksandr Pushkin epic, and Evenings on a Farm near Dikanka (1961) is an adaptation of a story by Nikolay Gogol. There is no Soviet Invasion of the Body Snatchers, but some movies manage to work in anti-Western views. The Amphibian Man, shot in Cuba in 1962, offers a damning critique of capitalism in the person of its villain (Mikhail Kozakov), a dishonest, slave-driving, anything-for-a-pearl bastard who wants to marry the girl our hero loves — against her will, of course. Zero City, filmed at the height of perestroika, includes a speech by the town prosecutor (Vladimir Menshov) against European ideas, which he says are all the more fatal for their rationality and practicality.

This is not to say that the Soviet Union escapes its directors’ indignation. The clearest examples come at its end points, the start and finish of the great people’s experiment. Aelita shows class conflict and housing shortages; made more than 60 years later, 1988’s Zero City depicts the denunciation and rehabilitation of rock ‘n’ roll and its partisans as caprices all the worse for their life-destroying results. But the most transparent criticism comes in 2005’s First on the Moon. Made well past the fall of the USSR, the film is a look back, documentary style, at its country’s space program, which in this version beat the Americans’ to the earth’s natural satellite. There are winks to the fictionality of this exercise via sometimes too-cinematic shots, but the most obvious touches are images such as that of a group of children saluting with straight faces "the cause of Stalin and Lenin," then breaking into laughter. The government appears at its worst when it covers up the successful trip and spends years trying to contain the cosmonaut who made it, but the fact that the Soviets never did get to the moon — let alone first — is the movie’s strongest critique.<\!s>*

Careers and Ed: A life of death

A kid gets killed in the cross fire of a shooting. Someone digs up a human skull while planting begonias. An elderly woman dies in her sleep in an apartment no one has visited in years.

In all these cases, somebody — or somebodies — has to examine the scene and, well, the bodies to find out what happened. And as any fan of hard-boiled detective stories, CSI, or Quincy, M.E. knows, those somebodies are the forensic team, perhaps most prominently the coroner.

It’s a mysterious job with macabre connotations, imbued with a mix of excitement and dread. A new show on Spike purports to show armchair detectives what it’s really like, with Grand Guignol bravado, but I always wonder, is that really how it is? So I decided to find out.

GOING DOWNTOWN


I start with our own fair city of night, only to discover that the subject of coroners is more complicated than I thought. What TV often portrays as one or two jobs is often many different jobs. And San Francisco County doesn’t have a coroner — a position defined as an elected or appointed government official who deals with deaths that raise questions. Instead, it has a medical examiner, whose office is headed by an MD or doctor of osteopathy. The difference may seem like semantics, but it’s an important distinction for people in the field.

I also learn that it will be next to impossible to meet San Francisco’s medical examiner, Dr. Amy Hart. Unlike her predecessor, Dr. Boyd Stephens — whose media accessibility and subsequent scrutiny led to controversies about the reuse of needles, improper ventilation against dangerous pathogens in autopsy rooms, misappropriation of funds, and sexual harassment — Hart is fairly shy when it comes to the media. Public controversy can be a downside to the job, whether it’s over the contested findings of Los Angeles’ fabled "coroner to the stars" or the unpopular study by Marin County’s coroner of suicides on the Golden Gate Bridge.

So I get the basics about the job from Hart’s deputy administrative director, Stephen Gelman, at the ’50s-era Medical Examiner’s Office on the grounds of the Hall of Justice. Gelman, a middle-aged, white-haired former special agent with the Department of the Treasury, explains the makeup of the office: 32 people, including forensic pathologists and anthropologists, toxicologists, chemists, investigators, and administrative personnel.

And becoming part of Hart’s team isn’t easy, especially since forensic-themed TV shows and the office’s involvement with UC San Francisco managed to attract 160 applicants during a recent call for three positions. Preference is given to those with a background in medicine and, at the very least, the funeral industry.

"IT’S CHINATOWN …"


But those are just the facts. My experience at the Alameda County Coroner’s Bureau, an art deco, cream-colored building on the outskirts of Chinatown, is much more visceral.

Inside I meet the genial Lt. Jason Arone, who explains that the bureau has been under the jurisdiction of the Alameda County Sheriff’s Office since 1989. That gives Sheriff Gregory Ahern the title of chief coroner, but on a day-to-day basis, Arone is the guy in charge. I also meet Mike Yost, a former detective who is now a public administrator, which means he handles the belongings of decedents, from pets to hidden stashes of money.

Downstairs, the morgue is pretty much what movies would have you expect: cold metal and antiseptic green tile. Arone pauses at the sound of a saw — we can’t go inside if there’s an autopsy under way. But it’s just carpenters fixing a door. Inside, I’m struck by the lack of sliding-drawer coolers — bodies are identified by photograph these days and are kept in less-obvious storage rooms.

Then I meet autopsy technician Smiley Anderson — sometimes referred to as "the bullet finder" by resident pathologists. The 25-year veteran started working in his family’s mortuary as young man in the South — much the way many in coroner’s offices got their start. But Anderson says the field is changing now. Crossover careers are rarer, and he says the best way to get in is through an education in medicine.

As I sit at his desk outside the autopsy room, I notice what Arone calls "the meat-locker smell." It’s neither the smell of embalming fluid that I associate with funerals nor that of decay — just a stale, permeating reminder of what’s inside.

OUT IN THE FIELD


It’s midafternoon when I meet Alameda County Coroner’s Bureau detective Eric Larson, who’s agreed to show me the other side of the job: going out on calls. I wait with the jocular thirtysomething until two calls come in.

One is a follow-up from the night before. A young girl and her brother were at the house of a family friend, which also serves as a rehabilitation facility; soon after dinner both fell ill. The brother recovered, but the young girl died. Larson decides to ask some questions, though the toxicology report is still pending.

The other call is a notification about a suicide on the Golden Gate Bridge. (Sometimes Alameda County representatives will handle calls for Marin County if the next of kin is in the East Bay.)

Larson puts on his flak jacket as part of his routine, and we get into one of the department’s cars. Since it’s not a pickup, he says, we won’t need one of the vans.

The first stop is at a sagging west Oakland house. The man who answers the door is barely coherent but sends us to Children’s Hospital. When we get there, I’m amazed to see the little boy we got the call about bouncing up and down, chewing on a french fry. When he sees Larson, he starts singing, "Bad boys, bad boys …" Larson laughs and says, "That’s my favorite song, buddy." The child’s hale liveliness is heartbreaking with the knowledge I have of his sister.

Larson asks the family friend, who’s at the hospital, for any information on the night before. It’s unclear whether he’ll get answers, and he tells me that sometimes he never does. In fact, that’s one of the hardest parts of the job. "It doesn’t matter how much science you throw at it," he says. "Sometimes it comes out undetermined."

It’s getting late as we head to the home of the suicide victim’s sister in Castro Valley. No one answers the door. Larson checks with the Marin County Coroner’s Office for another address, then stops by a dispatch office to get directions. Notification is important to Larson, as people may otherwise never hear about the fates of their loved ones.

We arrive in a quiet, ’70s-era housing tract in San Leandro, at the house of the victim’s mother. Again, no one is home, but a neighbor with emergency keys checks the house, determining that the victim’s mother has gone for a walk with her dogs. We wait at the house.

When she arrives, she knows what Larson’s going to say before he opens his mouth — but the news is no less brutal. When we leave, her neighbors are sitting beside her on the couch, friends from happier, simpler times.

It’s late when we return to the office, and Larson is supposed to work another swing shift tomorrow. But he gets a message from home. The son of a friend died in an accident. The funeral is tomorrow.*

The devil’s bargain at the Transbay Terminal

If you don’t like the notion of a 1,200-foot tower scarring San Francisco’s skyline — and I don’t — then maybe you ought to read this fascinating piece on Calitics, and stop for a minute to think about what this city, and this state, is doing.

Why do we have to live with a giant highrise office tower near the Transbay Terminal? Because if we don’t, there won’t be any money to build what should be the central transit link for the Bay Area, a landmark bus and train station on the scale (we’re told) of Grand Central in New York. It’s an essential part of the city’s future.

But the project costs a lot of money, almost a billion dollars — and nobody wants to pay higher taxes to fund this sort of thing. In fact, nobody in California wants to pay higher taxes for anything. So the folks at City Hall have decided that the only way we can have a new transit terminal is if we hock a piece of our city and our skyline to fund it. So we take some of the land on the terminal site and let a developer build a monstrosity of a highrise on it — and that will bring in the money that we can’t get any other way.

It ‘s the same reason we have that god-awful RIncon Tower sticking its ugly head into the sky: The developer offered to pay for a fair amount of affordable housing and other community amenities that the taxayers won’t fund because local government can’t raise taxes in California without reaching extraordinary lengths that are almost politically impossible. So here’s the deal: You want affordable housing? Give a big developer the rights to do something awful, and in exchange, we’ll get a few dollops of cash for civic needs.

Imagine, for a moment, what the state might look like if we’d had to cut this kind of deal to build the University of California system. You want nice colleges? Okay — sell off the coast and let it become a giant Miami Beach. You don’t want to do that? Too bad — no world-class university system for your kids.

This is the devil’s bargain we have agreed to settle for in 2007, and it sucks.

The homeless sweep won’t work

I came to San Francisco in 1981, and there were people sleeping in Golden Gate Park. Dianne Feinstein, who was the chief exec back then, would periodically try to get rid of them. Art Agnos and Frank Jordan did the same thing. At one point in the 1990s, when Willie Brown was mayor, he discovered the shocking fact as if for the first time, and had a team sweep the campers out. Now the Chronicle has gotten the scoop yet again, and the mayor has dispatched his shock troops and is trying it all anew.

It won’t work this time, either.

There simply aren’t enough places for homeless people to sleep in this town. The shelters are unpleasant and often dangerous, and don’t work for people who are opposite-sex couples (all the shelters are men- or women-only) or people who have dogs (and there are quite a few homeless people with dogs). They aren’t a long-term answer for people who drink or take drugs, since they’re all alcohol and drug-free (or are supposed to be).

The transitional housing the mayor is promoting is fine — but there are thousands of homeless people and not enough rooms for all of them. So if you sweep the park, you just get homeless people sleeping in doorways.

McGoldrick lets us down

Jake McGoldrick was the swing vote on the wrong side on the 3400 Cesar Chavez project. Some interesting comments and debate here.

I don’t think McGoldrick is corrupt (as one commenter says at leftinsf), and I’m not going to support the attempt to recall him (as another proposes), but I’m deeply disappointed. McGoldrick is a housing guy; he knows better than this.

I live near 3400 Cesar Chavez, and the plan is terrible for the neighborhood. We could have stopped it, and opened the door to a real affordable housing effort. Damn.

It didn’t matter how soon paramedics arrived. Kevin Noah, a 42-year-old carpenter with three sons, had no chance. The accidental 50-foot plunge from his perch on the Golden Gate Bridge killed him immediately.

Noah’s dizzyingly high station was a mere cross section of rebar — the slender iron braids that are often seen protruding from construction sites and provide a structure with skeletal support — inside an anchorage house located on a landbound portion of the bridge’s southern end.

Moments before on that August 2002 morning, Noah had been performing his normal duties, receiving planks of wood from another worker for use in forming a temporary frame to contain a wall of fresh concrete. The bridge was a year into phase two of its multimillion-dollar retrofit, which today is nearly complete.

Suddenly, the clip on Noah’s brace slid off the edge of an open-ended piece of rebar, and a nearby worker looked up just in time to see Noah’s body collide with the extended boom of an industrial cherry picker before falling the rest of the way to the ground, according to an account in public workplace-safety records.

In February 2003, Cal/OSHA, of California’s Division of Occupational Safety and Health, concluded its investigation and penalized the retrofit’s prime contractor, joint venture Shimmick-Obayashi, for, among other things, allegedly failing to properly rig Noah’s fall protection and not providing workers with scaffolding to stand on in construction areas where the footing was less than 20 inches wide. Fines for the violations — three of them designated by the agency as serious — totaled more than $26,000.

But Shimmick-Obayashi wouldn’t pay a dime.

The outfit immediately turned to the Cal/OSHA Appeals Board, and since such cases are backlogged statewide, the matter didn’t reach an administrative judge until this year, when attorneys for Shimmick-Obayashi presented a peculiar defense. Cal/OSHA, they argued, sent the company citations through the mail that failed to list the full legal name of the company: the mailings were addressed to Shimmick-Obayashi instead of Shimmick Construction Company, Inc./Obayashi Corporation, Joint Venture.

The misstatement was akin to a cop failing to note "Esq." or "Jr." on a parking ticket. Cal/OSHA pleaded with the judge, Barbara Steinhardt-Carter, that "it is against civil law, board precedent, and public policy to dismiss this matter based on a minor technical fault that misled no one and caused no prejudice."

Steinhardt-Carter, however, bought the company’s claim and ruled earlier this year that Shimmick-Obayashi was liable for none of the fines, even though Cal/OSHA got the name it used from the company’s business cards.

Throughout a three-year period during which the parties exchanged memos, motions, and discovery material, the contractor’s lawyers never mentioned a problem with the original citations, Cal/OSHA spokesperson Dean Fryer told the Guardian, and variations of the name Shimmick-Obayashi appear on several court documents. The move was a last-minute Hail Mary by a cunning industry lawyer who represents several major players in the business. And it worked.

"The outcome of this case is really surprising and disappointing to our staff," Fryer said. "They went through a long and thorough investigative process, and their work is now basically disposed of."

That Shimmick-Obayashi attorney, Robert D. Peterson, knows more about workplace-safety laws than most. He literally wrote the Cal/OSHA handbook commonly used by employers today and served as chief counsel to the appeals board until 1978. That’s when he established his own law firm and began representing large-scale employers in occupational-safety and workers’ compensation proceedings.

"The bottom line is, if the division has a responsibility to identify correctly the employer that it’s alleging created a violation of a safety order [and] it doesn’t do that, then the citation won’t stand the light of day," Peterson told the Guardian. "Apparently, they didn’t do that. It’s a pretty simple thing to do."

Mammoth civil engineering concerns commonly form temporary partnerships, as several have done to bid on the half-dozen Bay Area bridge retrofit projects initiated by the state at a cost of billions of dollars since the Loma Prieta earthquake rattled the coastline in 1989.

Shimmick-Obayashi won its $122 million phase two contract in 2001 to replace the Golden Gate Bridge’s steel support towers and reinforce its pylons. That came after phase one more than doubled in cost to $71 million by the time it was completed that year under another contractor. All told, Shimmick-Obayashi will earn more than $150 million following a series of change orders, a spokesperson for the bridge agency told us.

The joint venture’s initial bid beat out those of four other firms, including the politically well-connected Tutor-Saliba Corp., which later earned $760 million in a partnership with two other companies to reinforce the Richmond–<\d>San Rafael Bridge. We’ve previously reported on the dozens of injuries and the three deaths that have occurred during that project (see "Lessons from the Bridge," 11/14/06).

Obayashi on its own has had a string of run-ins with Cal/OSHA in recent years. Last March regulators hit its local housing construction subsidiary with $27,000 in fines for allegedly failing to maintain proper railings at a site in downtown Oakland, according to a federal Occupational Safety and Health Administration database analysis. The company is currently fighting those penalties. In February it was fined $6,400 for an alleged lack of railings at a project in the Bayview. Overall, the company has $60,475 in statewide open Cal/OSHA penalty cases dating to 2005.

Shimmick’s cases are few since 2000, but in the middle of last year, Cal/OSHA issued the firm two serious citations totaling $36,000 in fines after an aerial lift carrying an ironworker reportedly fell off a 34-inch light-rail platform during construction of the Muni’s T Third line, "ejecting the employee into the fast lane of traffic." The 52-year-old man was taken to San Francisco General Hospital with a serious skull fracture. A safety director for Shimmick, Ike Riser, argued that despite the accident, Shimmick has one of the best safety programs in the state.

The incentive to keep even small settlements from blemishing a safety record is huge for contractors because they can lead to the escalation of insurance rates and make bidders less competitive. Cal/OSHA’s Fryer said that while Shimmick and Obayashi have faced serious recent incidents, together they have had relatively few problems on the Golden Gate Bridge.

"It doesn’t appear with the joint venture that there is really a pattern of concern," he said. "It’s just that this specific incident resulted in the fatality of a worker, when it could have been prevented."

Noah’s mother, Sandra, told us that her son began doing carpentry at age 16 and always preferred working on big jobs. She was unaware of the ruling until we reached her, long after Cal/OSHA first cited the contractor, but she believes Shimmick-Obayashi deserved the penalties.

"To leave three sons behind," she said, "that’s the real tragedy."<\!s>*

Dust devils

A year has passed since Lennar Corp. officials admitted that subcontractor CH2M Hill failed to install batteries in dust-monitoring equipment at Parcel A, a construction site in Hunters Point Shipyard where an asbestos-laden hilltop was graded to build 1,600 condominiums (see "The Corporation That Ate San Francisco," 3/14/07).

The admission sparked a steadily growing political firestorm in Bayview–Hunters Point, further fueled by evidence that Gordon Ball, another Lennar subcontractor, for six months failed to adequately water the site to control dust and by a racially charged lawsuit in which three African American employees of Lennar allege they were subjected to discrimination and retaliation after they refused to remain silent about the dust issue. The lawsuit, set for a case management hearing Aug. 17, also claims that Ball committed fraud involving the Redevelopment Agency’s minority-hiring requirements.

Bayview–Hunters Point residents angry about the situation have found an ally in Sup. Chris Daly, who has called for a halt to construction at the site until an independent health assessment is conducted to the satisfaction of the community, including the Muhammad University of Islam School, which is adjacent to the Parcel A site and has been exposed to dust. The Board of Supervisors was scheduled to consider Daly’s resolution Jul. 31, after the Guardian‘s press time.

"This issue is of such a high level of importance," Daly told us. "There’s now a mandate for progressives in San Francisco to talk about environmental justice and to take action."

Sup. Sophie Maxwell, whose district includes the shipyard, told us that she understands the concerns of Daly and the community. "But when you get down it … the dust is inconvenient, but it is not harmful in the long term," she said.

Maxwell believes the city’s Department of Public Health should have done more outreach and updates, "but it has brought the situation under control." That sentiment was echoed by the city’s environmental health director, Dr. Rajiv Bhatia, who told us, "This is the first time we have implemented dust control, and this is an industry that had never been regulated. And in the end, things got better. We did our job in pushing a regulated community that grudgingly complied with our regulations."

In June, after residents complained that the dust was causing nosebleeds, headaches, and asthma, the DPH released a fact sheet that stated, "You may have heard there are reasons to worry about your health because of the construction dust generated by the redevelopment of Parcel A of the Hunters Point Shipyard. That is not true."

A July 5 informational DPH memo claims that when workers tried to do dust training and outreach at the end of June, their efforts "were significantly hindered by representatives of the Muhammad University of Islam," who allegedly disrupted training sessions, followed DPH workers, and told residents not to listen to the DPH workers.

On July 9, DPH director Mitch Katz testified at a hearing of the supervisors’ Land Use Committee that the city had imposed the highest standards possible to control dust. Katz also claimed that exposure to the dust was not toxic and that there is no proof that health problems were caused by the dust.

But at the same hearing, Nation of Islam minister Christopher Muhammad demanded testing "by people the community can trust," and he accused the city of "environmental racism." Noting that asbestos-related diseases often don’t manifest themselves for at least 20 years, Muhammad claimed, "The problem that we’re seeing in Bayview–Hunters Point is dust related."

After the DPH abandoned plans to do door-to-door outreach in favor of a series of health fairs, a coalition of activists calling itself POWER (People Organized to Win Employment Rights), some wearing masks and hazmat suits, closed down a July 17 homeownership seminar at Lennar’s shipyard trailer.

"Some folks did a picket outside, while inside, folks who own homes or live in public housing in the area were asking a lot of questions," POWER’s Alicia Schwartz told us. "We are for development that prioritizes the needs of low-income communities of color who have long been absent from the decision-making process, not development that puts the health and safety of families and the elderly at risk."

Two days later Marcia Rosen resigned as executive director of the San Francisco Redevelopment Agency. SFRA board member London Breed told us that the resignation was "a long time coming" and said she wished Rosen had taken a stronger stand on Lennar and Ball in the winter of 2006.

Breed says the agency "will always be a bad word to African Americans because of what happened in the Western Addition…. But we have a great opportunity in Bayview–Hunters Point to make it into something wonderful for the community."

Maxwell, whose grandson attended the Muhammad school’s Third Street campus, wonders why the minister refuses to move his students back to Third Street. "Lennar understands that this has become a PR nightmare and they are going to have to get contractors who are supportive of and understand the rules and regulations," said Maxwell, who is about to introduce legislation that she hopes will better control construction dust citywide.

Meanwhile, Dr. Arelious Walker of the True Hope Church of God in Christ told us that he and a group of like-minded pastors have formed the African American Revitalization Consortium, "a highly vocal and visible group in strong opposition to the shutting down of the shipyard without scientific proof."

"We support 100 percent the notion that the dust from Parcel A does not cause any long-term health risks. The project must continue because of its economic impacts. One little group does not speak for us all," said Walker, who met with Mayor Gavin Newsom, Maxwell, and Katz on July 23.

Acknowledging that the outcry over Parcel A has raised awareness of the dust issue, Walker said, "For years in the urban community, the environment was not the issue, but now we’ve woken up." Walker and his fellow ministers rallied about 200 people at City Hall on July 24 to express support for Lennar’s development and confidence in city officials.

Yet Daly said that faith may be misplaced: "It’s going to be a struggle to deal with the construction-related impacts of Lennar’s development at the shipyard, but the issue is much bigger, and it points to the need for an alliance between progressives, the African American community, and the southeast neighborhoods." *

Frankly, I’m not terribly disappointed to hear that Matt Gonzalez isn’t running for mayor. Having basically bowed out of public life after losing the last mayor’s race, I just didn’t see how he was a good rallying point for the progressive movement, let alone a real threat to win.
But I was a bit irked to read Gavin Newsom’s campaign manager Eric Jaye’s comment to the Chronicle: “They’re in total collapse,” Jaye said of the city’s progressives. “They had all year to organize themselves … as they get weaker, we get stronger.”
Really? A strong mayor might stand up to the Police Officers Association to demand reform or accountability, or to the downtown forces that are suing to kill the city’s new health plan and going to the ballot to undo neighborhood-based parking policies developed over the last three decades, or showing leadership (rather than a petulant “take it or leave it” attitude) in fixing his flawed wifi proposal, or doing something to create more affordable housing rather than just kowtowing to the developers of million-dollar condos, or doing his job and initiating official misconduct proceedings against Sup. Ed Jew. Instead, Camp Newsom seems to believe that they get stronger by taking weak stands and thus preserving political capital.
Apparently, it’s a strategy that has been effective enough to stay popular and clear the field of competitors. But as long as we keep buying our ink by the barrel, the Guardian will keep countering the self-serving spin of our ineffective by photogenic celebrity mayor.

Iraqi refugees who manage to make it out of Iraq still can’t work, have difficulty attending school and are not eligible for health care. Many still need to return to Iraq to escape poverty, according to BBC news.

Key housing vote on tuesday

The supervisors will vote Tuesday on whether to allow high-end condos and (another!) Walgreens in the Mission at 3400 Cesar Chavez. Leftinsf has a good summary of the issue. I live in the area, and I can tell you: the last thing we need are more condos for the rich and another damn Walgreens.

This is insanity; The site, like so many in the Eastern Neighborhoods, ought to be preserved for community-based affordable housing. There aren’t many places left to build housing of any sort, and every time you turn one of them over to the get-rich-quick speculators and developers, you lose a site for housing that would allow working people and families to stay in the city.

Sup. Tom Ammiano wants affordable housing on the site, and typically the supes defer to the district representative on these sorts of things. But this time, both Jake McGoldrick and Bevan Dufty may be leaning toward the developers.

It’s true that there isn’t, at the moment, a community alternative with the funding to move forward. But if the private developers take this site over, there never will be. It’s worth delaying the process to give affordable housing a chance.

TECHSPLOITATION The future is a crowded graveyard, full of dead possibilities. Each headstone marks a timeline that never happened, and there’s something genuinely mournful about them. I get misty-eyed looking at century-old drawings of the zeppelin-crammed skyline over "tomorrow’s cities." It reminds me that the realities we think are just around the corner may die before they’re born.

A few weeks ago I was trolling YouTube and stumbled across a now-hilarious documentary from 1972, Future Shock, based on the 1970 futurist book of the same name by Alvin Toffler. The documentary focused on a few themes from the book and tarted them up by throwing in a lot of trippy effects and sticking in Orson Welles as a narrator.

As Welles intones ponderously about how fast the future is arriving, we learn that "someday soon" everybody will be linked via computers. Essentially, it was an extremely accurate prediction about Internet culture. Score one for old Toffler.

Things go tragically incorrect when the documentary turns to biology. Very soon, Welles assures his audience, people will have complete control over the genome and drugs will cure everything from anxiety to aging. Through the wonders of pharmaceuticals, we’ll become a race of immortal super-humans. It sounds almost exactly like the kinds of crap that futurists say now, 37 years later. Singularity peddlers like futurist Ray Kurzweil and genomics robber baron Craig Venter are always crowing about how we’re just about to seize control over our genomes and live forever. So far we haven’t. But every generation dreams about it, hoping they’ll be the first humans to cheat death.

Some dreams of the future, however, shouldn’t outlast the generation that first conceived them. Suburbia is one of those dreams. In the fat post-war years of the 1940s and ’50s, it seemed like a great idea to build low-density housing to blanket the harsh desert landscapes of the Southwest. But now the green lawns of Southern California have become an environmental nightmare of water-sucking parasitism. Just think of the atrocious carbon footprint left behind when you lay pavement, wires, and pipes over a vast area so that nuclear families can each have huge yards and swimming pools instead of living intelligently in high-density green skyscrapers surrounded by organic farms.

Oh wait — I just gave away my own crazy futurist dreams, inspired by urban environmentalism. Today, many of us imagine that the future will be like the green city of Dongtan, an ecofriendly community being built outside Shanghai using recycled water, green building materials, and urban gardens that will allow no cars within its limits. The hope is that Dongtan will have a teeny tiny carbon footprint and be a model of urban life for the future. Of course, that’s what suburbia was supposed to be too — a model of a good future life. No future is ever perfect.

Perhaps the saddest dead futures, though, are the ones whose end may mean the end of humanity. I suppose one could argue that the death of an environmentally conscious future is in that category. But what I’m talking about are past predictions that humans would colonize the moon and outer space. As the dream of a Mars colony withers and the idea of colonizing the moons of Saturn and Jupiter becomes more of a fantasy than ever before, I feel real despair.

Maybe my desperate hopes for space colonization are my version of Kurzweil’s prediction that one day we’ll take drugs that will make us immortal. Somehow, I think, if we could just have diverted the global war machine into a space-colony machine sometime back in the 1930s, then everything would be all right. Today the planet wouldn’t be suffering from overpopulation, plague, and starvation. We’d all be spread out across the solar system, tending our terraforming machines and growing weird crops in the sands of Mars.

Of course, we might just be polluting every planet we touch and bringing our stupid dreams of conquering the genome to a bunch of poor nonhuman creatures with no defenses. But I still miss that future of outer-space colonies. I can’t help but think it would be better than the future we’ve got. *

No waterfront highrises

EDITORIAL We’ve been concerned for decades about development along San Francisco’s waterfront, and with good reason: the Port of San Francisco has done a generally miserable job of managing one of the city’s most significant resources. In the 1960s and 1970s, the port effectively gave up on the shipping industry, losing container freight (and plenty of good blue-collar jobs) to Oakland. Development proposals for port property, particularly under then-mayor Willie Brown’s administration, were largely horrible.

And now the port wants the state to turn over development rights for some key seawall-protected properties, which could be turned into very-high-end housing with ground-floor retail. The port needs the money for historic preservation and is promising to build some waterfront parks, which is all well and good. But when it comes to building expensive housing along the waterfront, we’re dubious right off the bat — and even more dubious now that Port Director Monique Moyer is howling about the prospect of a 40-foot height limit.

Sen. Carole Migden has introduced legislation, Senate Bill 815, that would authorize the port to lease out for development lots that are now part of a state trust. But at the request of neighborhood groups, she wants height limits included in the deal as part of state law.

The port argues that 40 feet is too low for, say, three stories of housing above a storefront. Besides, port staffers say, zoning issues should be a local decision, and the state should hand over the lots and let the city decide on height, bulk, density, and appropriate use. In principle, we’d tend to agree with that — but the City Planning Department today is a disaster, with every key decision driven by developers, and the last thing this city needs is a string of high-rise condos on the waterfront.

If the port’s land is going to be developed, it has to be done with tremendous sensitivity, clear public benefits — and inflexible, mandated height limits. And if the money is going to go to parks, we’d like to see specifics, in advance: which projects will pay for which parks, and where — and what guarantees do we have that they’ll ever be completed?

This is the kind of decision that will affect the city for a century or more. Migden’s right: we should take it slowly and carefully. *

The Chris Daly show

Oh, it’s so easy to make fun of Chris Daly. You can even make fun of his beard.

Or you can watch his much-derided speech at the Board of Supervisors, and recognize that: 1. He’s not a crazed nut; his points are cogent, well argued and entirely credible, and; 2. He’s right.

Daly is right: We should spend more money on affordable housing than on new roads. We should delay hiring more cops so we can save public health nurses. (Actually, we should raise taxes hire both cops and nurses, but that’s not in the cards right now.) The fact it, the mayor’s budget priorities are all screwed up.

Yes, budgets are always a compromise, and this district-elected board has done better, consistently, than any at-large board at keeping the mayor’s budgets relatively humane. I agree that Daly does himself no favors — and more than that, I fear that he does some harm to the cause of district elections. He says he cares nothing about his own political career, that he’s not a politician (which is one of the most charming and wonderful things about him), but he’s also part of a movement, and district elections is absolutely, utterly critical to the future of progressive politics in this city, and his fits of temper make the whole board look bad, and that helps the mayor’s candidates for supervisor and the people who would like to get rid of district elections altogether.

I think Daly needs to stop giving his enemies so much ammunition. There’s a lot more at stake here than one budget or one person’s future.

Still, I keep watching that speech, and I keep saying:

Shit, on the issues, the guy is right.

Tweeking the tidelands

With the furor over her erratic driving incident still lingering and a primary challenge from Assemblymember Mark Leno starting to get nasty, state senator Carole Migden is now wading into another potentially pungent political pool.

This time around, the battle involves the state’s laws governing coastal land use, the Port of San Francisco’s revenue needs, and the competing interests of folks who live along, work near, or simply like to relax and recreate along the city’s bayside waterfront.

Migden’s Senate Bill 815 would make three major changes to the ancient and arcane laws that govern the use of the state’s tidelands. It would allow the port to rent out 11 seawall-protected properties, currently used for surface parking lots, for development over 75 years, after which they would return to the public trust.

It would also permit the port to sell off "paper streets" — lots that serve as view corridors, public rights-of-way, and connections between the city and its waterfront, including portions of Texas, Custer, Ingalls, and Davidson streets developed with warehouses, as well as the recently closed Hunters Point Power Plant.

Last, Migden’s bill would allow the transfer of the 36-acre, federally owned Jobs Corps parcel on Treasure Island to local control as part of an exchange of public trust and nontrust lands on Treasure and Yerba Buena islands.

Port special project manager Brad Benson told the Guardian that the local agency worked with the California State Lands Commission for two years on ways to help increase the port’s revenue-generating capabilities, and this bill was the result.

"We cc’d the neighborhood organizations on the amendments that we sent to Migden’s office on June 12, and we invited further discussion," Benson said of the proposal, which is intended to help cover the port’s estimated $1.4 billion cost for seismic retrofits and restorations, hazardous-material remediation, storm-water management, and improved waterfront access by relaxing the land-use restriction of the 1969 Burton Act.

The Burton Act gave the port control of San Francisco’s waterfront from Fisherman’s Wharf to Candlestick Point, including 39 historic finger piers between Fisherman’s Wharf and China Basin. But it also limited the port to leasing seawall lots for street purposes such as surface parking while giving it the financial responsibility of maintaining and restoring the historical waterfront.

Today just about everybody agrees that surface parking is a horrible use of the seawall lots — with the possible exception of the Giants, who want to retain 2,000 spaces on the 14-acre lot they lease next to Mission Creek. But in recent weeks disagreement has broken out over last-minute amendments that were added to Migden’s bill June 20 to impose height limits on four seawall lots in the Northeastern Waterfront Historic District and remove a fifth lot entirely.

Those amendments were added following input from neighborhood groups like the Telegraph Hill Dwellers, the Barbary Coast Neighborhood Association, and the Friends of the Golden Gate, a 1,400-member nonprofit whose stated goal is "to preserve open recreational space for the citizens of San Francisco."

In a June 20 letter to Migden, Telegraph Hill Dwellers president Vedica Puri argued for height limits on the basis of a "visual and historic connection between the waterfront and Telegraph Hill" created by "higher structures closer to the base of Telegraph Hill and lower buildings near the Embarcadero." Noting that three of the disputed lots are currently zoned for heights of 40 feet, with the fourth lot, closer to Telegraph Hill, zoned for 65 feet, Puri argued for respecting local height limits in place as of January.

Meanwhile, the Barbary Coast Neighborhood Association, the Telegraph Hill Dwellers, and the Friends of the Golden Gate asked that lot 351, which abuts the Golden Gate Tennis and Swim Club, be excluded from the deal.

"There is an ongoing struggle in the Barbary Coast neighborhood over an outsize condominium project usually known as the 8 Washington Project," Jonathan Middlebrook of the association’s Waterfront Action Group warned.

Friends of the Golden Gate chair Lee Radner, in a June 29 letter to Loni Hancock, chair of the Assembly’s Natural Resources Committee, argued for keeping lot 351 under the public trust because it "abuts the open recreational space, along the Embarcadero, Washington, and Drumm streets."

"Lot 351, if removed from the public trust," Radner wrote, "will give a developer the option to build high-rise, exclusive, and costly condominiums that would spill over into the recreational space and change the open view corridors to Telegraph Hill and Coit Tower forever, limit the light and views of many neighbors, and impact the traffic on an already congested Embarcadero."

But two local planning and land-use groups argue that Migden’s amended legislation would wrest control of height restrictions from the local planning process and benefit a well-heeled few at the expense of everyone else.

Tom Radulovich, executive director of Livable City, said he believes height limits and urban design should be decided at the local level. "The problem with stipuutf8g a 40-foot height limit is that you end up getting squashed retail space, creating a pokey, unpleasant atmosphere," said Radulovich, who’d rather see the lots taken out of the bill than included with those provisions. "To my mind the question is: how do builders create a great street? And what building controls help achieve that goal? We wanted to make these lots more walkable, bikeable, and accessible to contribute to the overall public good with the maximum opportunity for local control. The latest amendments tip the balance towards state interference, and that’s inappropriate."

Tim Colen of the Housing Action Coalition accuses the neighborhood associations of "not wanting any height increases or other uses to the extent that it might threaten their view." Colen said developer Simon Snellgrove of Pacific Waterfront Partners is interested in lot 351, which lies across from the Ferry Building, to create high-end condos, mixed-use residential units, and 34 below-market-rate units.

He acknowledges that the Golden Gate Tennis and Swim Club would lose three tennis courts under the legislation. "But this is a chance for 34 families to get housing and be able to stay in San Francisco," Colen said. "The Golden Gate Tennis and Swim Club is a really sweet facility, but it ain’t public recreation. Migden’s bill benefits some very well-heeled people when the interests of many are at stake."

Migden’s bill, which cleared the Senate but must return for final approval because of the amendments, is set to work its way through the Assembly by August. Benson said continued negotiations would be a good thing. "We appreciate Senator Migden’s work, but we believe height limits are a locals-only matter to be decided by the Board of Supervisors and the mayor."

But the Barbary Coast Neighborhood Association’s Diana Taylor said her group "spent hours getting the community informed, telling the port what we wanted, until eventually we came up with a bottom line, what our compromises were…. That’s where senator Carole Migden developed amendments, and this was the first time that we came to a coordinated agreement. But now we find out that the port isn’t happy with some of the amendments. What we’d like to see is a more clear-cut strategy to bring the port and the communities together. We’re adversaries right now, but we shouldn’t be."

With the port set to have a public discussion July 31 about lot 337 (the Giants’ parking lot next to Mission Creek), Jennifer Clary of San Francisco Tomorrow notes that Mission Creek is home to 60 species of birds. As she said, "Isn’t habitat preservation and restoration part of urban development? Is it really a choice between people and birds? Is that the decision?"<\!s>*

Years in development and 600 pages thick, the Eastern Neighborhoods Plan Draft Environmental Impact Report is a policy wonk’s wet dream, but perhaps a tad inaccessible for most people. That’s too bad because this is the plan that could determine whether there will still be jobs and homes for the working class 20 years from now, or whether policymakers will let the free market continue to gentrify the city. The plan (available here along with important info on upcoming hearing and a series of workshops that start on Monday) looks at three development options, ranging from maximum conversion of industrial lands to housing to maximum preservation of job-producing properties. Either way, the plan will almost double the housing entitlements in the city and create a potential developer feeding frenzy that could have irreversible results. But the plan also calls for proactive policies for creating more affordable housing, exacting more public benefits from development projects, and creating development models that take public health into consideration, all firsts for the city’s area plans. The Eastern Neighborhoods Plan has become a high-stakes battleground involving anxious developers stalled by a temporary building moratorium, progressives who want more affordable housing, concerns about dwindling light-industrial spaces and an exodus of African American residents, environmental justice, and a list of other issues that are central to this sprawling section of the city.

But the folks in the neighborhood known as Western SoMa are just happy that they’re no longer a part of that mess. Instead, they’re excitedly experimenting with a new approach to planning using an innovative and largely untested grassroots model.

Five years ago, when the city Planning Department first announced its intention to rezone the Eastern Neighborhoods, a group of disenchanted SoMa residents decided that they wanted to secede from that process and develop an independent, more comprehensive, community-based plan.

"A lot of us were offended by the Planning Department’s top-down, autocratic process," Jim Meko, who later became chair of the Western SoMa Citizens Planning Task Force, told the Guardian. "It was a bad process for everybody, but it was particularly bad for SoMa because the neighborhood had already been rezoned in the 1990s."

Meko survived three major demographic shifts within three decades: the AIDS epidemic that decimated SoMa’s gay community, the live-work loft zoning loopholes that gutted the artistic community, and the dot-com crash that displaced many techies. He feared that the Eastern Neighborhoods Plan would impose a "one-size-fits-all mode that treated all of SoMa like postindustrial wasteland."

So Meko set his sights on pressuring the Planning Commission to split his neighborhood from the rest of the Eastern Neighborhoods, which include the Mission District, Eastern SoMa, Showplace Square, Potrero Hill, and the Central Waterfront. Western SoMa is bordered by Mission and Bryant, 13th and Fourth streets, and Harrison and Townsend.

That dream became a reality in February 2004, and that November the Western SoMa Citizens Planning Task Force formed, with a stated objective to "recommend zoning changes that will preserve the heart and soul of their neighborhood, while planning for the realities of 21st-century growth."

Since beginning its work in 2005, the 22-member task force has met as often as five times a month and has created a values statement; a set of planning principles; committees focusing on business and land use, transportation, and arts and entertainment; and a committee that integrates a variety of issues.

Its June 28 town hall meeting was the first time the task force threw the doors open to the community at large, although the occasion happened to come on the heels of a high-profile budget battle between Mayor Gavin Newsom and Sup. Chris Daly, whose district includes SoMa and who helped set up the task force.

Within five minutes of Meko’s kicking off the meeting, a small but vocal group of attendees began to heckle him midspeech. Perhaps they were there to confront Daly, who had been slated to attend but was out of town. Whatever the reason, while accusing Meko of "having an agenda" and "using the bully pulpit" to present his own views, this faction was anxious to know how many task force members are property owners and which particular group of them would be dealing with crime, the fight against which Newsom has made a top budget priority.

For one wobbly, tension-filled moment, it felt as if this first crack at a citizen planning forum might crumble. But then another participant saved the day by requesting a simple but basic meeting ground rule: no personal attacks.

From that moment, the mood in the room lightened. Pretty soon the rest of the 150 residents who had gathered in the multipurpose room of Bessie Carmichael School on Seventh Street to share their thoughts on Western SoMa were talking about what they liked and what could improve. Even the hecklers quieted down and seemed to meld into the discussion.

As Planning Commissioner Christina Olague put it at the meeting, "This is possibly one of the most exciting things going on in planning. No one understands the heart and soul of a neighborhood like the people who live there. We hope this is a model other neighborhoods will adopt, because a neighborhood plan without the involvement of neighbors who live and breath a community is chaos — just a bunch of buildings zoned in a language no one can read or feel."

But while residents were happy to create lists of neighborhood needs — more parks, bike lanes, affordable housing, child care facilities, and trees; wider sidewalks; and fewer homeless people — they were less keen on the idea of increasing building heights. One proposed means of financing improvements would be to increase allowable heights from 40 to 65 feet in some places.

Some locals complained about partygoers who urinate in the streets and play music loudly in cars instead of going home when the clubs close. But a youthful resident politely pointed out that "it may not be possible to stop young people from being young."

In the face of requests from senior citizens for more dinner theater and fewer nightclubs in SoMa, task force member and nightclub owner Terrance Allen observed that it’s probably only possible to "nudge existing conditions."

Recalling the battle that broke out between residents and partygoers after city planners decided to put affordable housing next to the wildly popular nightclub 1015 Folsom, Allen said, "You don’t want to start a war by putting subsidized housing next to the city’s biggest nightclub." Or as Meko put it, "We don’t want to set up conflicts by putting family housing across from the Stud."

By evening’s end, the consensus was that the meeting was a success. "We have much more in common than we have apart. That’s the whole key," said Marc Salomon, who sits on the task force’s transportation committee. As Meko told the Guardian the next day, "Wasn’t it a fantastic experience? It was the closest thing to a cocktail party without a bartender."

Meko said the task force is eager to complete its work and is shooting for having a draft plan ready by the next town hall meeting, on Oct. 24.

"But we need to do more community outreach," he added, noting that there weren’t many Filipinos at the first meeting even though they have a large presence in Western SoMa. "We’re looking at what SoMa could be like in 20 years. The other Eastern Neighborhoods are watching, and they are envious." *

The truth about housing money

OPINION Just as in war, in 2007 San Francisco budget politics, truth is the first casualty.

Nowhere is this more obvious than in the assertions by Gavin Newsom’s campaign minions that the mayor’s current budget proposal contains a $217.5 million city investment in affordable housing.

The purpose of these claims is to imply that Newsom has voluntarily allocated local tax dollars for this critical need — and that no more should be spent on affordable housing, especially some $10 million for lower-income rental housing production for families with children proposed by Supervisor Chris Daly and the Board of Supervisors.

The facts tell a different story.

First, the impression that this $217.5 million is all local tax money the mayor has voluntarily invested in affordable housing is false. Some $20 million is federal and state money that can be spent only on affordable housing. Another $25 million comes from local sources and also must be used for affordable housing. And $48 million comes from tax-increment funds mandated by a 2005 supervisors policy to go solely toward affordable-housing development.

So about 40 percent ($93 million) of the affordable-housing funding that the Mayor’s Office talks about was money that by law had to go to affordable housing. It wasn’t Newsom’s choice.

Nearly a third of the mayor’s budget for creating affordable housing — some $60 million — is in fact allocated to fund his Care Not Cash program, which was supposed to pay for itself. Indeed, more than twice as much money, $31 million, is earmarked to pay for privately owned, leased residential hotel rooms for temporary housing of the homeless (not producing one new affordable home) as is budgeted for the production of new, permanently affordable lower-income family rental housing ($15 million). The fact is, the 2007–08 Newsom budget cuts $24 million in funds earmarked for new affordable-housing production for families and seniors.

What is most distressing about the half-truths and nontruths in the affordable-housing budget battle of recent days is that the unity between the mayor and the Board of Supervisors — crucial to the expansion of affordable-housing opportunities for San Franciscans and which has characterized the city since the George Moscone administration (some 25,000 permanently affordable homes have been produced in the past 20 years, a figure unmatched in any other mayor American city) — has been placed in peril for short-term political advantage.

But cooler heads have prevailed inside and outside City Hall. Sometimes it is better to shut up and do what needs doing and let the credit fall where it may.

Which is why, when the dust settled last week, no one shouted about the $10 million that was quietly added back into the budget for permanently affordable family-housing production.

But we should all be clear: if we want San Francisco to be as economically diverse as we all claim, then we have only just begun to find the funds needed for more affordable housing. While it may or may not be true that you can never be too rich or too thin, it is most certainly true that San Francisco never allocates enough for affordable housing. *

Fourth of July week is supposed to be slow; when I worked for a daily newspaper, we used to do long stories on the fireworks displays just to fill space on the pages. Not here. There’s so much going on it’s hard to keep track of it all, but here’s a quick rundown on what San Francisco is facing this week:

A bill that would lift a veil of secrecy hanging over police misconduct cases is stuck in the Assembly Committee on Public Safety — and Fiona Ma is one of those holding it up. Ma is a protégé of John Burton, who wasn’t easily intimidated, but she’s acting as if she’s terrified of the police lobby, which has mounted a major effort to kill the bill. It’s crazy — Ma has a fairly safe seat, and unlike some Democrats in marginal districts, she doesn’t have to fear that the cops will back a Republican against her. This is one of the worst moments in her career in Sacramento thus far, and she needs to get off the fence and back the bill when it comes up for reconsideration.

The long-awaited draft environmental impact report for the Eastern Neighborhoods zoning project just came out, and it says just about what I and many others had expected: following the proposals that the City Planning Department is putting forward would wipe out a fair number of blue-collar jobs and would not provide anywhere near enough affordable housing to meet the city’s stated needs. This ought to be a central issue in the mayor’s race (if there ever really is one); I’m not willing to accept as inevitable the loss of working-class San Francisco, and neither should the mayor.

Mayor Gavin Newsom finally signed the Community Choice Aggregation bill (see page 10) — but not with the sort of fanfare you’d expect for a program that could profoundly change the city’s energy future. Sen. Carole Migden has come forward with a bill to ensure that the power from city-owned renewable-energy projects is available to the city and doesn’t have to go into Pacific Gas and Electric Co.’s maw.

Speaking of Migden: who exactly is paying for all those billboards with her face on them, touting her leadership? As we discuss on the www.sfbg.com politics blog, it’s a fascinating question. Michael Colbruno, a spokesperson for Clear Channel, which owns the billboards, refuses to say. He insists that the ads are simply "issue advocacy," which means nobody has to disclose who paid the tab. I’m not going argue campaign law with Clear Channel, but I suspect that Migden knows who gave her this nice present, worth tens of thousands of dollars. Perhaps she’ll share that information with the rest of us.

In the meantime, the folks at the San Francisco Chamber of Commerce — those great champions of open government who love privatization and refused to support the Sunshine Initiative — have a sunshine measure of their own. They want the supervisors to hold hearings before placing anything on the ballot. That’s a direct attack on some recent ballot measures the chamber didn’t like.

I’m all for hearings. Hearings are good. But the law would require that the hearings be held 45 days in advance of the ballot, and that would be a serious drawback for progressives who want to get measures that couldn’t pass the board on the ballot. Frankly, I’m dubious about the chamber’s motives.*

A clear housing choice in the Mission

OPINION On April 19 the San Francisco Planning Department approved a market-rate condo development with a 24-hour Walgreens store at the northwest corner of César Chávez and Mission. The project features 60 expensive ownership units and 67 residential parking spaces. To support the Walgreens, the developer is also including 24 customer parking spaces, 12 spaces for employees, and one car-share space.

The development as proposed is not in compliance with the city’s General Plan, the recent Eastern Neighborhoods planning requirements, or the January Board of Supervisors resolution calling for 64 percent of all new housing to be available at below-market rates — and there’s an alternative that offers true low-income family housing and community space. If the supervisors are serious about preserving affordable housing, they’ll reject this ill-conceived plan.

The developer, Seven Hills Properties, told the Planning Commission that families would be able to afford these simple, unadorned condos through the first-time home buyers services offered by the Down Payment Assistance Loan Program in the Mayor’s Office of Housing. The truth is that the developer is offering only nine below-market units affordable to working- and middle-class families. All of the other units will be priced at close to $550,000 for a studio and as much as $700,000 for a three-bedroom unit.

Think about those prices. A person or family making as much as $63,850 a year could qualify for the down-payment assistance. Such a person or family would have to come up with a $27,500 share of the down payment and would be paying about $3,000 a month for a mortgage — 55 percent of their income.

It doesn’t have to be this way. Back in December 2006, Seven Hills told the Mission Anti-Displacement Coalition that it would be interested in selling the development rights at the site to MAC if MAC could come up with a development proposal. MAC then worked with us at the Bernal Heights Neighborhood Center, and together we created a viable offer — which Seven Hills dismissed as unrealistic.

Our proposal was to develop between 60 and 70 units of affordable housing, with community-service space below. Across the street, in 2001, the BHNC opened its Bernal Gateway development, 55 affordable family units with on-site community services that subsequently won two highly coveted national awards, with a financing strategy similar to the one we suggested for the Seven Hills property.

MAC has appealed to the Board of Supervisors, which is scheduled to hear its appeal July 17. This is a neighborhood issue that has citywide implications.

The arguments couldn’t be more clear or compelling: The project doesn’t comply with the Planning Department’s own guidelines. It brings pricey housing and a chain store to a neighborhood that needs neither. And there’s a credible alternative that ought to be given a chance. *

Fix Newsom’s bad budget

EDITORIAL Annual budgets can seem wonky and impenetrable, but they’re perhaps the most important statements of a city’s values and priorities. That’s why it’s critically important for the Board of Supervisors to make significant changes to Mayor Gavin Newsom’s proposed $6 billion spending plan, which is out of step with what San Francisco should be about.

Ideally, this month’s budget hearings would be informed by an honest and open discussion of what Newsom proposed in his June 1 budget, how it affects residents and Newsom’s political interests, and where the board might want to make some changes.

Unfortunately, both the San Francisco Chronicle and the Examiner have failed to offer a substantial analysis of the budget; instead, they’ve focused on sensational headlines about whether the mayor has used cocaine, personality conflicts between Newsom and Sup. Chris Daly (including a pair of over-the-top hit pieces on Daly in the June 23 Chron), and misleading spin coming from Newsom’s office and reelection campaign.

But there’s plenty of good budget analysis out there, thanks to the work of city agencies such as the Controller’s Office and the Board of Supervisors’ Budget Analyst Office, nonprofits like the People’s Budget Coalition, smart citizens like Marc Salomon, and reporting by the Guardian‘s Sarah Phelan ("The Budget’s Opening Battle," 6/20/07) and Chris Albon ("Newsom Cuts Poverty Programs," 6/20/07).

What that analysis shows is that the mayor’s much-ballyhooed "back-to-basics" budget — which prioritizes public safety, cityscape improvements, home ownership programs, and pet projects such as Project Homeless Connect — would make unconscionable cuts to essential social services and affordable housing programs, rely way too much on gimmicks and private capital to address public needs, and offer almost nothing that is innovative or befitting a progressive city at a crucial point in history.

Some specific examples and recommendations:

Newsom’s 4 percent cut in the Department of Public Health budget — which his appointed Health Commission took the unusual step of refusing to implement because the fat has already been trimmed away in previous budgets — is unacceptable. It would slash substance abuse treatment, homeless and HIV/AIDs services, and other programs that would simply be unavailable if the city didn’t fund them. The board should fully restore that funding and even consider providing seed money for innovative new programs that would help lift people out of poverty. Only after the city fully meets the needs of its most vulnerable citizens should it consider cosmetic fixes like expanded street cleaning.

• The budget should strike a balance on cityscape improvements that is lacking now. Contrary to the alternative budget proposed by Daly, which would have cut the $6.6 million that Newsom proposed for street improvements, we agree with the SF Bicycle Coalition that many streets are dangerous and in need of repair. It’s a public health and safety issue when cars and bikes need to swerve around potholes. But the $2.9 million in sidewalk improvements could probably be scaled back to just deal with accessibility issues rather than cosmetic concerns. And we don’t agree with Newsom’s plan to add 100 blocks and $2.1 million to the Corridors street-cleaning program, which already wastes far too much money, water, chemicals, and other resources.

As we mentioned last week ("More Cops Aren’t Enough," 6/20/07), the police budget doesn’t need the extra $33 million that Newsom is proposing, at least not until he’s willing to facilitate a public discussion about the San Francisco Police Department’s mission and lack of accountability. Sup. Ross Mirkarimi (a progressive who is strong on public safety and even clashed with Daly over the issue) was right to recently challenge the terrible contract that Newsom negotiated with the cops, which gives them a 25 percent pay increase and asks almost nothing in return.

Newsom’s housing budget would move about $50 million from renter and affordable-housing programs into initiatives promoting home ownership, which is just not a realistic option for most residents and represents a shift in city priorities that serves developers more than citizens. Some of that change is specific to a couple of big owner-occupied yet fairly affordable projects in the pipeline for next year, but the budget also does little to address the fact that we are steadily losing ground in meeting the goal in the General Plan’s Housing Element of making 62 percent of new housing affordable to most residents, when we should be expanding these programs by at least the $28 million that the board approved but Newsom rejected. Similarly, the board should keep pushing the Housing Authority to apply for federal Hope VI funds to make needed improvements to the public housing projects rather than supporting Newsom’s Hope SF, which purports to magically turn a $5 million expenditure into $700 million in housing — as long as we accept the devil’s bargain of 700 to 900 market-rate condos along with the public housing units.

Finally, there are lots of little items in Newsom’s budget that could be cut to find funding for more important city priorities. Don’t give him $1.1 million to hassle the homeless in Golden Gate Park or $700,000 for his New York–style community court in the Tenderloin.

The bottom line is that a progressive city should not be pandering to the cops, punishing the poor, and polishing up its streets when so many of its citizens are struggling just to find shelter and make it to the next month. Newsom has forgotten about the ideals that the Democratic Party once embraced, but it’s not too late for the Board of Supervisors to correct that mistake. *

Budget blowback

People’s Budget Coalition member Esther Morales says she’s angry that the media obsessed over Sup. Chris Daly’s June 19 comments about whether Mayor Gavin Newsom has honestly addressed allegations that he’s used cocaine yet ignored hours of testimony that hundreds of San Franciscans gave at the very same meeting, a state-mandated hearing on the impact of Newsom’s proposed spending cuts on the city’s neediest populations, including those with drug and alcohol problems.

"There’s been so much press about that hearing, but it’s all been about what’s happening between Sup. Chris Daly and the mayor," Morales said, accurately observing that there has been no coverage by the mainstream media of the addicts who waited for hours that night but only got to talk for two minutes each about how they would have died had it not been for the substance abuse programs that Newsom plans to cut.

Nor has much been written about the folks who pleaded for Buster’s Place, the city’s only all-night homeless shelter, which was to close at the end of June unless the Board of Supervisors saved it from Newsom’s $1.6 million cut. Nor has much mention been made of the organizers from the city’s four single-room occupancy hotel collaboratives that showed up at City Hall a few days earlier to decry Newsom’s proposed $233,000 cut in their combined budgets.

As David Ho of the Chinatown Community Development Center told the Guardian, "These are programs for the poor and for public health, and they are always on the chopping block. The mayor talks about the need to preserve working-class families in the city, and here we are being left out of the budget."

Muna Landers of the Coalition on Homelessness said SRO hotel rooms were originally meant to be single dwellings, but now more than 450 families — 85 percent of whom are immigrants — live in such rooms without bathrooms or kitchens. "When one family moves out, three families move in," Landers said.

Meanwhile, in light of Newsom’s proposal to restore only 50 percent of a $9 million federal cut in San Francisco’s HIV/AIDS programs, San Francisco AIDS Housing Alliance director Brian Basinger accused the mayor of "playing bullshit games."

As Morales told us this week, "What’s really behind these fights between Chris and the mayor is the fact that Chris spearheaded the board’s $28 million affordable-housing supplement…. Without Daly’s footwork the $28 million supplemental would not have passed by an 8–3 majority, and the mayor only refused to sign it because it was Chris’s measure."

Morales works with 60 community-based groups as the organizer of the Family Budget Committee, one of seven committees of the People’s Budget Coalition, which unveiled its annual report June 21 on the steps of City Hall. The group values services for those struggling to get by.

"But this mayor’s budget is a law-and-order, streets-and-potholes, increasingly right-wing conservative budget that is not reflective of what San Francisco is about, and it will drive even more families out of town," Morales told us.

Months ago the Family Budget Committee met with the mayor’s staff to ask for a $30 million package of services, part of the People’s Budget Coalition’s $78 million request from the mayor’s record $6.1 billion budget.

"The mayor’s staff talked to us about how dismal the budget year looked, how the firefighters’, the police[‘s], and the nurses’ contracts are up for negotiations, and so they didn’t know how much money they would end up with," Morales recalled.

So the Family Budget Committee whittled down its needs, first to $20 million, then $10 million, and sent those priorities to the Mayor’s Office for consideration. Ultimately, it said, the mayor found just $1.5 million for its priorities, so it turned its attention to the Board of Supervisors.

Since board president Aaron Peskin removed Daly as chair of the Budget and Finance Committee on June 15 and took the reins himself, the body has restored $4 million in HIV/AIDS funding, and much more is on the way. Peskin told us that he intends to significantly change the mayor’s budget, promising more so-called add backs than the board has ever approved.

"It’s all about priorities," Peskin told us. He said Daly "never intended to actually cut" any of the mayor’s top-priority projects when he introduced his motion to slash $37 million from Newsom’s funding plans. It was simply a negotiating tactic that "backfired majorly" when the targeted constituencies rallied against Daly.

Yet board progressives haven’t been derailed by Daly’s actions, as many pundits predicted. At the same meeting at which Daly mentioned cocaine while making a point about substance abuse program cuts, Sup. Ross Mirkarimi led a challenge of Newsom’s proposed San Francisco Police Department contract on the grounds that it would grant cops a 25 percent pay increase but give the city little in return. And there are still eight supervisors who supported Daly’s affordable-housing plan.

Peskin told us, "I’m hopeful that by the end of the week you’ll be able to write that Peskin took the baton that Newsom handed him, and while it may not have been as pretty as we might have liked, I’m hopeful that after reversing cuts to health care and [making the additions requested by] the Family Budget Committee, we’ll even be able to dump money back into low-income, affordable, family, and rental housing." *

Court smacks SF Planning Dept.

The Chron buried the news deep in the local section, but a June 22 state Court of Appeal decision on the validity of the Housing Element of the city’s General Plan was a huge slap in the face to the mayor and the planning director.

In essence, the court ruled that the city can’t adopt the new Housing Element without doing an environmental impact report. You can read the decision here.

I’ll admit: The folks who sued, a group of West side homeowners who don’t want more density in their neighborhoods, are not my favorite activists. I’ve never thought it was fair that all the density had to go on the East side of town, and that nobody West of 19th Ave. even had to think about it.

That’s the essence of the suit: The Housing Element might encourage more housing on the West side of town, and might allow housing without a lot of parking, and that might lead to congestion and traffic issues. As my old friend Ron Curran used to say, Boo Fucking Hoo: The rest of us in town have lived with those issues for years, and anyone with any sense knows that new housing in this overdeveloped town will need to be transit-oriented and not car-oriented.

Still, the plaintiffs made an excellent point: The Planning Department should have done an EIR on the Housing Element. IN fact, the Planning Department should do a lot better in the environmental review department generally. You just go forawrd with these big projects and zoning changes and refuse to acknowledge the impacts, and you’re eventually going to get smacked.
