Class of 2010: Jane Kim

Despite fears that a candidate backed by downtown could replace firebrand progressive leader Sup. Chris Daly in District 6, in the end it was the two progressive candidates — Jane Kim and Debra Walker — who finished far in front of the large pack of candidates, with Kim winning the race. And she thinks that says something about how the progressive movement has matured.

“To have the two leading candidates be progressives says a lot about the progressive political community,” Kim said. “The race was really between Debra and me in end.”

Kim, a 33-year-old attorney and the outgoing president of the San Francisco Board of Education, has been active in progressive politics in San Francisco for many years, from doing community organizing with the Chinatown Community Development Center to running the short-lived San Francisco People’s Organization, which Daly helped create.

Yet part of her campaign strategy, and the message that she’s sending in the wake of an election that divided the progressive community, focuses on issues and themes that are more common to political moderates: job creation, clean streets, public safety, and neighborhood services.

“I think it’s important for progressives to cross over, and I don’t think it should be viewed as selling out,” Kim told us. “Progressives need to do a good job at maintaining voters’ faith in the progressives’ ability to lead.”

In addition to courting progressive groups and voters, Kim’s campaign aggressively targeted residents of the residential condo towers in Rincon Hill and Eastern SoMa, voters who are generally more affluent and newer to San Francisco than the typical progressive constituencies.

“It’s a lot of new residents who don’t feel like they’re a part of any political faction and they’re really open,” Kim said. “People just want to see that things are better. They want the streets to be clean and safe.”

With a new mayor and new blood on the Board of Supervisors, Kim said this is an important political moment for San Francisco, “a huge opportunity” to redefine San Francisco politics in the wake of Mayor Gavin Newsom and progressive supervisors such as Aaron Peskin, Matt Gonzalez, Tom Ammiano, and Daly.

“The Class of 2000 was able to show how progressive we can be with policy. They really pushed the envelope,” Kim said, citing new worker and tenant protections and programs such as Healthy San Francisco. Now, she said, the challenge for progressives in the Classes of 2010 and 2008 is to show that they can provide effective leadership in realms like public safety and economic development. “If we’re able to lead on those two issues, it would really firm up our leadership of the city,” Kim said, noting that it would also affect the dynamics of next year’s mayor’s race.

While Kim didn’t go into detail about how she intends to deal with what she says is the biggest challenge facing the new board — a budget deficit of $700 million over two years, coming at a time when all the easy cuts have already been made in recent years — she said the city needs to be aggressive in boosting the local economy and ensuring San Franciscans get most city contracts.

“We need to figure out how we can partner with small business to create a diversity of jobs in San Francisco,” she said, noting that the average San Franciscan has more faith in the moderates’ ability to create jobs, something that progressives need to address. But how can she help break the grip that the conservative San Francisco Chamber of Commerce has on small businesses?

“Part of the problem is that small businesses aren’t organized,” Kim said, noting how that hurt Sup. David Chiu’s ability to win support this year for his business tax reform measure that would have helped most small businesses and made some large corporations pay more taxes. “They’re busy running their businesses and they don’t have the time to look at the details, so they just read the briefing of the Chamber of Commerce.”

Kim said she respects the leadership role Daly has played in progressive politics and that she’d “like to be part of the moral compass of the Board of Supervisors.” But she also said that Daly’s sometimes abrasive style unnecessarily hardened the opposition of moderates to important progressive issues.

“He made it harder to talk about affordable housing,” Kim said, noting that the city’s dearth of affordable housing should be an issue that’s important to middle class voters, noting that it includes housing for people who earn up to 120 percent of the median income for the region. But after Daly hammered on the issue, “It was like a bad word coming out, and people would turn off to the issue.”

But she thinks it’s a fixable problem if she and her allies do the hard work, an ability they demonstrated this year by defeating Walker, who had been running for the seat for years and lining up all the key endorsements. “Voters do respond to campaigns that work really hard, and that bodes well for progressives,” Kim said, noting that she intends to reach out to Walker’s supporters. “I don’t think I can be successful as a supervisor if I don’t work with all the camps in the progressive community.”

Class of 2010: Malia Cohen

It took two weeks and 19 updates of San Francisco’s ranked-choice voting system before Malia Cohen, a former Mayor Gavin Newsom staffer and partner in a firm that helps businesses and nonprofits create public policy, was declared the winner of the hotly contested race to represent District 10, which includes Bayview, Hunters Point and Ingleside. The nail-biting time lag was a byproduct of complex calculations that involved 22 candidates, no clear front-runners, and a slew of absentee and provisional ballots.

But when the RCV dust settled, the results proved that the D10 vote continues to break down along class, race, and gender lines. These RCV patterns personally benefited Cohen’s success in picking up second- and third-place votes.

But they also helped D10’s African American community, now smaller than its growing Asian community but still larger that the black community in any other distinct in the city, send an African American supervisor back to City Hall. And it avoided a run-off between Lynette Sweet and Tony Kelly, who won most first-place votes.

Some chalk up Cohen’s victory to her polished appearance, the middle-of-the road positions she took on the campaign trail, and an impressive list of endorsements that include the San Francisco Democratic Party, the Labor Council, the Building and Construction Trades Council, state Sen. Leland Yee (D-SF), Assembly Speaker Pro Tempore Fiona Ma (D-SF), Board of Supervisors President David Chiu, SF Democratic Party Chair Aaron Peskin, and BART Board President James Fang.

But Cohen told us she thinks coalition building was the key. “Endorsements only account for a quarter of the reasons why you win,” she said. “It’s all about building an organization, a net that goes deep and wide.”

Some progressives were alarmed by a Dec. 1 fundraiser to help settle Cohen’s campaign debt whose guest list included Newsom, former Mayor Willie Brown, Sup. Sean Elsbernd, Ma, Building Owners and Managers Association director Ken Cleaveland, Kevin Westlye of the Golden Gate Restaurant Association, and Janan New of San Francisco Apartment Association.

Cohen dismissed concerns over this conservative showing of après-campaign support. “Fear not,” she said. “It is a fundraiser event. And now that I’m a newly elected supervisor, I look forward to meeting everyone. And I will do a great job representing everyone.

So what should we expect from Cohen, who ran as a fourth-generation “daughter of the district from a labor family” on a platform of health, safety, and employment — and will soon represent the diverse southeast sector, which has the highest unemployment, crime, recidivism, foreclosure and African American out-migration rates citywide and is ground zero for Lennar Corp.’s plan to build thousands of condos at Candlestick and the shipyard?

“I’m a bridge-builder,” said Cohen, who attributes her surprisingly tough but open-minded edge to being the oldest of five sisters.

So far, she’s not going out on a progressive limb. She told us she favors a caretaker mayor: “I’d like someone to maintain the business of the city, someone who has zero political ambition,” she said. “That way it creates an even playing field for the mayoral race.”

Cohen says she is determined to address quality of life concerns, including filling potholes, re-striping crosswalks and introducing traffic calming measures, and taking on critical criminal justice issues, including City Attorney Dennis Herrera’s gang injunction in the Sunnydale public housing project in Visitacion Valley. She opposes Herrera’s strategy but notes: “If not gang injunctions, then what? I can’t dispute that they get short-term results, but what about the long-term impacts? We need long-term solutions.”

Cohen supports Sup. John Avalos’ efforts to pass mandatory local hire legislation but is open to “creative solutions” to help get it over the finishing line. “People who live here should be working here,” Cohen said. “But is 50 percent the magic mandatory hire number? I don’t know.”

Cohen, who just survived a foreclosure attempt, has promised to be a “fierce advocate” for constituents facing similar challenges, including those who met predatory loan brokers at church.

But asked how she would cut spending or raise revenue to address the city’s massive budget deficit, she had no specific answer.

Yet Cohen disagrees with detractors who say she lacks experience. “I may look cute, but don’t be misled. I have a public policy background and fire in my belly. I’m a union candidate, I’m smart, I’m talented, and above all, I love the people in D10 and the rest of San Francisco. I want everyone to prosper and receive benefits. So give me a shot.”

Class of 2010: Mark Farrell

Mark Farrell is a 36-year-old venture capitalist and political newcomer who will represent the wealthy neighborhoods of District 2 (Pacific Heights, Sea Cliff, and the Marina) after narrowly beating Janet Reilly, whose extensive political endorsements ranged from the Guardian and local Democratic Party Chair Aaron Peskin to U.S. Sen. Dianne Feinsein and Mayor Gavin Newsom.

Challenging the city’s political power structure is why Farrell said he ran for office, playing up his outsider status and investment banking experience. He told visitors to his campaign website, “I am running for the Board of Supervisors to bring common sense back to City Hall” and railed against “career politicians who run for office again and again.”

In an interview with the Guardian, Farrell said he was motivated to make his first foray into politics by the dysfunction he has heard about at City Hall. “I’ve been frustrated with City Hall over the last few years, from the personal antics to the policies that have come out,” Farrell told us. “I humbly believe I have something different to bring to the table.”

Farrell calls himself a fiscal conservative who believes “our city government has gotten too large and we need to look at that,” a task he thinks he’s well-suited for given his background in finance. Yet when asked what government functions he would eliminate or cut deeply to help close a projected $700 million budget deficit over the next two years, Farrell said he can’t offer any specifics yet, saying only, “We need to make tough decisions.”

Would Farrell be open to new taxes or other revenue-side budget solutions? He told us that he won’t completely reject the idea of new taxes, but that he generally opposes them. “I don’t believe in raising taxes. We can’t raise enough revenue to get out of this problem,” Farrell said. “We need to learn to live within our means.”

Although he opposed Prop. B in this election, Farrell said public employee pension reform needs to be a part of the city’s budget solution, as well as scaling back how much the city gives to nonprofit groups, which provide many of the social services the city supports.

Farrell was born and raised in San Francisco — except for his college years, he’s spent his whole life in D2, where his parents still live — and has been friends with Sup. Sean Elsbernd since high school. Politically, Farrell also identifies with Elsbernd and fellow fiscally conservative Sups. Carmen Chu and Michela Alioto-Pier (who endorsed Farrell to replace her in D2), but he says that he doesn’t want to be politically pigeon-holed.

“I’m very much my own person and I look forward to working with everyone,” Farrell said. Indeed, part of Farrell’s frustration with City Hall politics has been the divisive relationship between the progressives and moderates, which he sees as a hindrance to finding “common sense solutions.”

“The progressive and moderate labels have been relatively destructive to San Francisco,” Farrell said. “We need to get beyond that to focus on issues.”

Yet people’s political values and worldview determine what issues they care about and the solutions they favor. For example, progressives decry the dearth of affordable being built for San Franciscans and cite city studies showing that deficit will get worse as developers build ever-more market rate housing (see “Dollars or sense?” Sept. 28), particularly in a city that is two-thirds renters.

Farrell said he supports rent control (saying he was unfairly attacked during the campaign as anti renter) and sees the dwindling rental stock and lack of new affordable units being constructed as problems, but he doesn’t have a solution to those problems. In fact, Farrell supports allowing more condo conversions, which would make the problem worse, telling us, “I believe home ownership is something we should promote.”

He was also vague about how he will approach land use issues and how tough he’ll be with developers in having them meet city design guidelines and provide affordable housing and other community benefits, saying only, “We need to have sustainable development in the city.”

Yet the issues that do animate Farrell are those typically focused on by conservative D2 voters. Farrell lists his top priorities as seeing to his district’s needs, promoting private sector job creation (“I think a lot of lip service has been paid to it, but not a lot of action by City Hall,” he said), public safety, and quality-of-life issues (he supported Prop. L, the sit-lie ordinance, calling it “very reasonable”). Generally Farrell sees San Francisco as a city in he midst of a serious fiscal crisis, “and I want to create a San Francisco that is secure for the future over the long haul.”

Newsom’s homeless policy failure

I have no reson to dispute the figures in the Chron this morning showing that Mayor Newsom has moved 12,210 people off the streets of San Francisco, 6,692 of them placed into supportive housing and 5,518 shipped out of town with a free bus ticket. Randy Shaw, who has a city contract to run some of the hotels that Newsom is using for formerly homeless people, says Newsom has the “best record [on the issue] of any mayor in the United States”


And still the Chron laments, there are still homeless people on the streets:


Yet many of San Francisco’s neighborhoods remain plagued with panhandlers, and residents and tourists alike complain of feeling scared or just plain disgusted.


Let me suggest one possible reason that there’s so much panhandling still going on: Even the formerly homeless who now have residential hotel rooms don’t have enough money to eat. That’s because Newsom’s signature “Care Not Cash” measure took money away from welfare payments and shifted it into housing. These days, general assistance pays just $59 a month. Try living on that. Even with food stamps (which don’t buy you meals if you don’t have a kitchen to cook in) the money the city pays out is too little. So people beg for more.


Yes, there are people who panhandle to buy money for drink and drugs. Reality check here: People — homeless or otherwise — are going to drink and do drugs in this city. Give them enough money in a monthly welfare check and they’ll use that instead of bothering the tourists. Panhandling isn’t easy or pleasant; people don’t do it because they want to. They do it because there’s no other way to get money.


(And please, my trolls: Don’t tell me that these folks should “get a job.” There are currently five unemployed people for every job opening in America, and it’s worse in San Francisco.)


Of course, now that Newsom has decided to evict the Haight Ashbury Neighborhood Council recycling center — a place where homeless people can legally make a little money without panhandling — the problem’s going to get worse.  

Rec & Park trashes HANC Recycling Center

At yesterday’s Recreation & Park Commission meeting on Dec. 2, hundreds of San Francisco residents turned out to urge commissioners not to replace the Haight Ashbury Neighborhood Council (HANC) Recycling Center with a community garden. Their pleas fell on deaf ears.

It didn’t matter that a sunnier spot for a community garden had already been identified in the same area, with funding approved by the commission more than a year ago. It didn’t matter that thousands of people use the recycling center every month, and that the nonprofit bolsters community gardens throughout the city with donations and funding. It didn’t matter that we’re in a recession and there were jobs on the line. It didn’t matter that HANC pays rent to a city department facing a $12.5 million deficit, but the community garden would cost $250,000.

All that mattered in the end was that Rec & Park, and Mayor Gavin Newsom, wanted the HANC recycling center out. They thought removing it might discourage homeless people from sleeping in the park and hanging around the neighborhood. After nearly four hours of listening to residents urge them not to do it, the commissioners yawned and pushed the eject button. They unanimously voted in favor of the community garden. A 90-day eviction notice is expected to go out to HANC today.

The fight over HANC’s eviction has been described as a political battle between progressives and moderates, a showdown between heroes who stand up for public safety versus intimidating thugs and the lefties who enable them, and even a sequel to the sit /lie controversy. I think there’s an 800-pound gorilla sitting in the middle of this fight that no one wants to talk about: Class.

Community gardens are wonderfully empowering. I used to volunteer at one at a public housing complex in North Carolina. It was especially important for people who lived in that low-income community, since they benefited from nutritious produce that also lowered their grocery bills. Under the city’s plan for this new, gated community garden, 30 of the 40 garden plots will go to area residents. Given the affluence of that neighborhood, the garden beds will likely go to people who can afford organic groceries at Whole Foods without breaking into a sweat. For well-to-do San Franciscans, growing produce is not a means of survival — it’s about feeling good, and being green. By itself, there’s nothing wrong with that.

The problem is that it will be installed at the expense of a long-standing community resource that employs 10 people and lightens the load for hundreds of others during a recession, when people are truly struggling to get by. The Rec & Park Commission has essentially decided that this parcel of public space should be taken from a nonprofit that benefits people of all classes, and given to a small number of residents who’ve voiced complaints about “quality-of-life issues.”

In its current function, the HANC Recycling Center is empowering to many different kinds of people. Most aren’t homeless. Tough-as-nails Asian grandmas show up with bags full of cans that they can exchange for some extra spending money. Urban gardeners purchase native plants in hopes of pleasing native insects and birds. People on fixed incomes get a small financial boost by turning in recyclables.

A small number of the HANC Recycling Center patrons do sleep outside. In order to earn small amounts of cash for things like food, many of them have to go digging around in garbage cans, which is gross and humiliating. Why would someone paw through the garbage for hours, battling bees and germs, and then haul smelly bottles uphill in a shopping cart just to make a few bucks? My guess is that it’s to ward off desperation. They make their own work, and they get to eat.

“Some of them may use drugs,” one of the speakers acknowledged last night. “But,” he paused for dramatic effect. “Some of us use drugs, too.”

When sit / lie was under debate, critics wondered where the homeless were supposed to go, if they couldn’t sit on the sidewalks. Often, the reply was that they could go to the parks. But this latest attack on the homeless shows that they aren’t welcome there, either.

Let’s play the “local hire” numbers game

There’s been a lot of discussion at City Hall about the pressing need for mandatory local hire legislation, as opposed to San Francisco’s current “good faith” efforts. And it seems that everyone agrees upon is that something needs to be done, as the Board prepares to vote December 7 on Sup. John Avalos’ local hire proposal, which seeks to ensure that 50 percent of workers hired on city-funded construction projects will be local residents.
The move comes at a time of high unemployment in the recession-hit construction industry, but would kick in as San Francisco stands poised to spend $27 billion on public works projects over the next decade.
‘The city needs to leverage its funding position to ensure that our residents benefit from these investments,” Avalos said at a Dec. 1 committee hearing on his legislation, which would require 25 percent of hours on city-funded construction projects, to be worked by local residents in the first year. This rate would rise 5 percent each year to 50 percent.
It would also require 50 percent of apprentice hours to be worked by local residents in the first year (with out-of-state workers exempt from these requirements).

These requirements currently apply to each individual construction trade (carpenters, painters, laborers, operators, brick masons, plasterers) and not to overall project hours.

The city would pay incentive bonuses to contractors that exceed the requirements.
Contractors who failed to meet the requirements would have the option of paying liquidated damages to the city, or sponsoring apprentices during the project.

But a December 1 report from Ted Egan, the city’s chief economist, estimates the legislation would raise the city’s contracting costs by $9.3 million per year, while creating 350 jobs.
 
Egan breaks down the city’s estimated $9.3 million in contracting and administrative costs into three distinct piles: $2 million in higher bid costs from hiring the unemployed, $4.5 million in higher bid costs from hiring the already unemployed, and $2.8 million in higher costs associated with penalties.

‘This cost represents approximately 1 percent of the city’s $934 million estimated annual spending on covered projects,” Egan noted, adding that the cost to the city will be lower in early years, because unemployment is high now and labor is widely available.

“This is a conservative estimate,” Egan added, “as it assumes no contractor exceeds the target and receives incentive bonuses from the city, and also excludes any contractor productivity losses caused by breaking up core crews.”

Egan acknowledges that most city expenses are associated with inflated contractor bids.
“These will occur because the local supply of skilled trades workers is insufficient to meet the local hiring requirements of the legislation,” he observed. “Contractors will be forced to pay above-the-market wages to workers that already have jobs, and pay the city penalties because resident labor is unavailable in many trades. These costs will be passed on to the city. This excess cost to the city could largely be mitigated by choosing local hiring targets that better reflect local supply.”

“The legislation will increase local employment and associated spending at local businesses, at the cost of higher City contracting costs,” Egan warned. “The legislation creates a net spending and jobs benefit, as written; with recommended mitigations, the positive economic impact can increase, and the cost to the city can decline.”

Egan calculated that estimated costs to the city could be reduced to $2.4 million, if Avalos’ proposed legislation is amended in the following ways:

1.    Replace across-the-board 50 percent mandatory requirements with trade-specific mandates to reflect “supply and demand in each trade.”
Egan argues that across-the-board requirement would lead to higher contracting costs “for several trades where required demand exceeds current supply.”
These impacted occupations include operators, brick masons and plasterers, and represent 50 percent of projected demand for city projects, over the next ten years, Egan said.
“Other occupations, such as carpenters, painters, laborers, and drivers are less impacted and can sustain the scheduled mandate, provided goals are set on an industry-wide and not a project-by-project basis,” Egan stated.

2.    Require a study every two years “to modify requirements and assess progress to a 50 percent mandatory requirement.”
Egan’s report suggests that the city conduct a review for two years, and then set mandatory participation levels for two years for brick masons, block masons, stone masons, cement masons, carpet, floor and tile installers and finishers, concrete finishers and terrazzo workers, construction equipment operators (except paving, surfacing and tamping equipment operators), drywall installers, ceiling tile installers and tapers, electricians, pipe layers, plumbers, pipe fitters and steam fitters, plasterers, stucco masons, roofers and sheet metal workers.
Egan’s proposal is that the city assess the length of time required for each of these trades to develop a pool of qualified resident workers to support a 50 percent local hire mandate, and then, if necessary, propose amendments to the mandatory levels for these trades.

3.    Allow contractors to transfer credit hours
Egan suggests that contractors and sub-contractors could accumulate credit for hiring local residents on non-City funded projects, transfer those accumulated credit hours to other contractors, and apply those credit hours to contracts for covered projects to meet the applicable minimum mandatory hiring requirements, or work off assessed liquidated damages. “Transferred credit hours may only be applied against mandatory hiring requirements for the trade in which they were accumulated,” Egan’s report states.

4.    Eliminate incentive payments
Egan recommends eliminating incentive payments, “since the ability to transfer accumulated credit hours provides a similar, and more efficient, incentive for contractors to exceed targets.”

Egan notes that his analysis assumes that annual public works spending is equal to the 10-year average in the city’s capital plan, which is $3.1 billion.
“60 percent of that will be spent on projects not covered by the legislation, because they are state- or federal-funded,” Egan stated.

He predicts that unemployment in the trades will average 10 percent in the next decade.
“Current unemployment in construction is 20 percent in San Francisco,” Egan said.

Egan argued that allowing contractors that exceed local hire requirements to transfer the additional hours, within a trade, to other contractors “would allow the same local hiring targets to be met on an industry-wide basis, not a project-by-project basis.”

He also recommended eliminating proposed incentive payments.
‘Giving contractors the ability to sell their excess hours creates a private incentive to exceed hiring targets. Contractors which do not meet the local hire requirements will compensate those that do,’ Egan wrote.

But at a Dec. 1 hearing by the Board’s Budget and Finance committee, not everyone agreed with Egan’s findings.

Missing from his “economic costs” equation, some speakers observed, were estimated savings from reduced law enforcement costs and poverty rates, if residents got jobs.
Egan acknowledged that his report does not factor in socio-economic benefits of the plan.
‘It’s a very fair point, but it’s hard to quantify,” Egan told the Guardian.

And while Avalos’ legislation proposes to phase in the local hiring mandate over the course of six years, Egan’s report simply focuses on costs when the city hits 50 percent.

Egan said he could have broken down his report into a phased-in, year by year, basis.
“But it gives the impression of greater certainty,” Egan said, noting that it’s not clear how much the city is going to spend on construction next year. “So, given what we’re planning to spend over the next 10 years, here’s an average estimate,” he explained.

I asked Egan about his report’s claim that there is a 20 percent unemployment rate in the construction industry in San Francisco, given that other city officials, including Mayor Gavin Newsom and Sup. John Avalos, have cited a 40 percent rate.

“The 2009 census figures came out in November and it said that 20 percent of San Francisco residents who are in construction say they are unemployed,” Egan said.

He acknowledged that the 40 percent unemployment rate that Newsom and Avalos cited likely refers to unemployment among folks who work in San Francisco’s construction industry, but live outside the city, where housing prices are cheaper.

Asked if his office was recommending that the local hire percentage start at 20 percent, as some building trades requested during the Budget Committee hearing on Avalos’ proposal Egan indicated this was not the case.
“We don’t see a problem in year one,” Egan explained. “There are a lot of unemployed people in year one that are available, so that target is not hard to meet.

The main problem, to Egan’s mind, was not the mandatory 50 percent local hiring goal, per se, but the requirement that it be achieved by every individual trade.
“That’s why we recommend doing a process every two years to take a look at how good a job individual trades are doing, and then set targets based on the rates of producing a supply of qualified workers,” he said.

“Some won’t take seven years to achieve a 50 percent rate, but others could take much longer,” Egan explained. ‘Otherwise, contractors, will have to raise bids so they can afford to pull qualified workers off other contracts. That would lead to shuffling people around, and the city paying for it, without new people being trained.”

So, that’s where the conversation seems to be headed going into Tuesday’s Board meeting, with the building trades still pushing for amendments, and Avalos, the chief sponsor of the legislation, reportedly trying to win support from Sup. Bevan Dufty, so that he can pass veto-proof legislation before the end of the month. Stay tuned.

A rogue’s gallery of downtown power brokers and moderate politicians is lining up to give D10 supervisor-elect Malia Cohen money during a fundraiser at Democratic Party money man Wade Randlett’s house tonight (Wed/1). And while the group may be trying to buy the support of a candidate they didn’t support in the election, Cohen and some of her progressive supporters say she’s been open to developing relationships across the ideological spectrum.

“Fear not,” Cohen told us when we raised an eyebrow at the host committee, and she noted that most of those on the list didn’t endorse her candidacy. “It is a fundraiser event, and now that I’m a newly elected supervisor, I look forward to meeting everyone.”

The guest list includes Mayor Gavin Newsom, former Mayor Willie Brown, Sup. Sean Elsbernd, Assembly member Fiona Ma, Building Owners and Managers Association director Ken Cleaveland, lobbyist Sam Lauter, Brook Turner with Coalition for Better Housing, Kevin Westlye of Golden Gate Restaurant Association, Janan New of San Francisco Apartment Association, as well as building trades head Michael Theriault and Tim Paulson of the San Francisco Labor Council.

“That’s not my perception of it,” Randlett – who used to run the downtown political organization SFSOS – told us when we asked about downtown’s attempt to buy influence with a candidate who finished the campaign about $20,000 in debt. He also rejected the characterization that it was a high-roller event, noting that prices initially listed at $100-$500 have since been lowered to $50. “Anyone who wants to attend at any price is welcome,” he said.

“I think it’s smart of their part, because they didn’t support her in the election, to try to give her money in the end,” said Gabriel Haaland of SEIU Local 1021, which did endorse Cohen. “It remains to be seen where she’s going to land [politically], but it seems clear what this group is attempting to do, to influence her votes.”

Cohen also received endorsements from the San Francisco Democratic County Central Committee, its Chair Aaron Peskin, and Board of Supervisors President David Chiu, who says he isn’t concerned about the Randlett fundraiser. “I understand that she has been celebrating with people from across the ideological spectrum,” Chiu said.

Indeed, Cohen said she is anxious to get to know representatives of San Francisco constituencies across the spectrum, borrowing a line from Shirley Chisholm, the first African-American women elected to Congress, in calling herself “unbought and unbossed.” Cohen said, “I will do a great job representing everyone. I will protect the interests of District 10 residents.”

Randlett, who flamed out with SFSOS before reviving his standing as a top-tier Democratic Party fundraiser by being an early backer of Barack Obama’s presidential bid, told us that was a connection he shares with Cohen. “The only reason I supported Malia from the beginning and am hosting the event for her is that like me she was there for Barack from Springfield through election night, never wavered in her support for him, and continues to stick by him now, when fair weather friends are carping from the sidelines,” Randlett told us.

Paulson told us that Cohen asked him to co-host a fundraiser with Newsom – who Cohen once worked for although he didn’t support her in this election – and that he didn’t see the complete roster until a couple days ago. “I am surprised there was this list,” Paulson said of the groups that regularly oppose progressive candidates and legislation.

But Haaland said that labor and the left will also be reaching out to Cohen, whose lack of a strong ideological grounding and representation of a district slated for the city’s most ambitious redevelopment plans will make her a pivotal vote on the new board. “We have to do our best to reach out to her as well,” Haaland said.

 

The high harvest

CULTURE “There was some sweet in there and some spice — it was like finger food, you could eat it like chips.” Larry Medders, 11-year resident of the Cecil Williams Glide Community House, is showing off the new rooftop garden, installed by the San Francisco Zen Center, on top of his nine-story supportive housing complex. He’s talking about his introduction to kale.

Medders cooks for himself in his studio apartment and used to stick to the same meals. He likes pasta and herbal teas, which he now brews with the mint and chamomile growing upstairs. An older man from the South endowed with a becoming drawl, he comes up once a day “to water and make sure everything’s in its place.” At the opening ceremony for the new green space, Medders tried the iron-rich greens for the first time. “Now I’m hooked,” he says.

If a once-bare Tenderloin rooftop seems like an incongruous spot to grow spinach, carrots, lemons, blueberries, parsley, onions, and tomatoes (a few of the nascent crops at the Community House), it shouldn’t. The buzzing streets below Medders’ feet offer sparse play areas for children, occasional safety risks, and few places to buy fresh veggies.

The city has tried to attract grocery stores to the area, so far unsuccessfully. “Grocery store operators and other retailers perceive that the area is unsafe and have expressed concerns about the safety of their employees and customers,” says Amy Cohen, director of neighborhood business development. TL residents largely must content themselves with corner stores for neighborhood shopping trips — a bummer for low-income seniors who live in the area.

For the residents of Community House’s 55 units — many dealing with life post-addiction and homelessness and all low income — the roof was already a place to gather. Building barbeques were common. But they knew the rooftop could be much more. “I just wanted to see more greenery, because it really is beautiful,” Medders says.

Enter the San Francisco Zen Center (www.sfzc.org). The center has operated in tandem with Muir Beach’s Green Gulch Farm since the early 1970s, providing a green dojo for meditation students and producing organic produce for restaurants such as Greens in Fort Mason. Says Zen Center vice president Susan O’Connell, “the color green alone is calming, the oxygen and the sense of being surrounded by life.” Gardening can aid in one’s quest for enlightenment, she says. “Zen takes a lot of different forms, it’s not just sitting down.”

Taking inspiration from a garden next door on top of Glide Church, the Zen Center pledged to fill Community House’s communal space with veggies. Now 15 planter boxes built by construction training nonprofit Youth Builds stand at different heights so children and residents in wheelchairs can work them. There are compost bins, shaded tables, chairs, a sink where cooking classes will be held once a local artist finishes painting a mural on the surrounding wall.

The roof’s design, plotted by ex-Green Gulch apprentice Jamie Morf, is laid out so residents can socialize (when Medders and I toured the roof, three children were eating a late lunch on one of the round tables) as well as sit and be thoughtful in nooks designed with peace in mind. “One of the most important precursors to being able to meditate is called taking refuge. But that’s really hard for people in the Tenderloin,” O’Connell says.

We are joined by Patty Rose and Arlinda Van Brunt, two other long-term residents who, with Medders, have stepped up to form the core gardening group. The three teach me about the challenges of running a plot that belongs to every one of the residents living in a nine-story building, including many who have never tended a kitchen garden before. The learning curve can include beginner’s missteps, like overpicking a hardy green onion plant that the trio laments.

“Look at this,” Van Brunt, an energetic woman whose father’s landscaping career left her with a severe aversion to seeing mistreated plants, is pointing at a vertical potato cage that doesn’t seem to be producing the same bushy green leafs as its neighbor. “They overwatered it! It’s our first year, we’re still finding a lot of things out.”

But these kinds of small setbacks show that the garden is being used — and often, they lead to new discoveries in and of themselves. The aforementioned rotting potato cage attracted the notice of the roof’s nightcrawlers, which must have scooted the 10 feet between their two massive bins to the cage, where they were discovered by Van Brunt.

The composting process in the worm bins is now one of her favorite parts of the garden. With the aid of Medders, she lifts the heavy metal lid of one of the bins and pulls aside the shredded newspaper piled on top of the composting material. Underneath, there is a teeming, squirming mass of pink worms. Van Brunt tenderly fingers a handful of them. “Look at that, are they really breeding in there? The nastier it is, the more they like it,” she says, exhibiting the satisfaction of a woman who has taken charge of her food system.

A complex and controversial project that would involve five San Francisco hospitals — including building a huge showcase facility for the wealthy atop Cathedral Hill — has prompted a debate about what average city residents need from the health care system.

California Pacific Medical Center, an affiliate of Sutter Health, proposes to downsize St. Luke’s Hospital, which primarily serves a low-income population in the Mission District, as part of a $2.5 billion proposal to renovate and retrofit three existing medical campuses, close another one, and build housing and a megahospital on Cathedral Hill that would draw patients from around the country.

CPMC’s grandiose plan was being considered strictly as a land use decision, despite its far-reaching impact on the city’s health care system. So Sup. David Campos created legislation calling for the city to create a citywide health services master plan and to use that as another tool for gauging future medical projects.

Debate over that legislation left some activists on both sides unhappy, with progressives disappointed that it won’t be able to stop a CPMC project they see as neglectful of the poor, and moderates wary of creating a new way to challenge development projects in the face of widespread unemployment in the construction industry.

But it struck a fine enough balance to win 8-3 approval by the board Nov. 16, enough to override a threatened mayoral veto. “I’m really happy and excited about the passage of this legislation,” Campos told the Guardian after the vote.

The legislation has a two-part mandate, with the first part kicking in as soon as it has final approval. It requires the Planning Department, with input from the Department of Public Health, to prepare a health care services master plan to identify current and projected needs for health care services and where they should be provided.

The second part, which begins in 2013, requires Planning to determine whether medical projects are consistent with the findings of this plan. That delay is credited to a last-minute amendment Campos granted during a Nov. 15 committee hearing after the hospital industry complained that the process could jeopardize its ability to meet state-mandated seismic retrofitting deadlines for projects already in the planning pipeline.

The passage of Campos’ legislation comes eight months after President Barack Obama signed the Patient Protection and Affordable Care Act. Hailed by its supporters as the most significant change to the U.S. health care delivery systems in 40 years, the reform package has also been greeted with criticism on both ends of the political spectrum. Progressives complain that it relies too heavily on private insurance companies and medical providers, while Tea Party supporters says that it’s government run amok and they have vowed to “kill the bill.” Senate Minority Leader Mitch McConnell (R-Ky) recently compared so-called Obamacare to “tyranny” in a speech to conservative legal scholars.

But here in San Francisco, the debate over Campos’ legislation — as heated and divisive as it was at times — yielded a surprising amount of consensus around the long-neglected idea that government should play a role in health care planning.

 

PULLING THE PLUG

The passage of Campos’ legislation marks the first time in 30 years that a government entity has mandated health care services planning in California. That approach West Bay Health Systems Agency, whose creation he opposed as governor of California.

Lucy Johns, a San Francisco-based health care planning consultant who wrote the only health care services master plan California has ever had, recalls what happened in the mid-1970s after President Gerald Ford signed legislation that established health system agencies nationwide.

“California established 14 health systems agencies, including the West Bay Health System Agency, which governed the nine Bay Area counties,” Johns told the Guardian. “The legislation mandated that they be established by every state, with the federal government providing the funding. So every state had to decide how many, how big, and how structured the health system agencies would be.”

Johns notes that state legislators were constrained when it came to the decisions these health service agencies made. “The governing bodies of the health systems agencies had to have a membership that was 51 percent consumer and 49 percent healthcare provider, which included doctors, nurses, and hospital administrators,” she said.

That history served as a backdrop for discussion of the Campos legislation, with the Planning Department staff report noting, “With the elimination of the West Bay Health Systems Agency in 1981, there is no longer a routine or comprehensive analysis of health service resources, needs, trends, and local impacts conducted for changes to or within medical uses.”

“It’s truly a historic moment for San Francisco,” Campos said after his legislation passed its Nov. 16 first reading (the second and final reading is set for Nov. 23, after Guardian press time). “We are the first city in the country to make sure land use decisions are aligned to our health care needs. That’s an unprecedented step that will shape the future of healthcare planning for years to come.”

Campos acknowledged that the passage of Obama’s heath reform package — which includes a mandate to purchase private health insurance beginning in 2014 — was also a catalyst for his legislation, along with the CPMC project.

“But it had more to do with seeing that the city didn’t have the tools it needed to evaluate projects in terms of whether they met the city’s healthcare needs and how they might impact people’s access to healthcare,” Campos said. “The main catalyst came from the community, which felt it was being asked to make decisions that will have long-lasting health care implications, but didn’t have any way to understand those needs. Those concerns were compounded by changes at the national level — and the recognition that these changes offer us an opportunity to engage in planning.”

Campos’ legislative victory came two months after members of the Cathedral Hill Neighbors Association joined nurses, medical workers, patients, and community groups in voicing concerns at a Sept. 23 public hearing about the draft environmental impact report for CPMC’s Cathedral Hill hospital and the other facilities that are part of its proposal.

These groups collectively expressed fear that downsizing St. Luke’s, closing the CPMC California campus, and transforming CPMC Pacific campus to an outpatient-only hospital will force low-income people to travel farther to access health care services while offering better service to the wealthy at Cathedral Hill. And neighbors worried that the proposed complex would increase traffic and require the demolition of rent-controlled apartments.

Formed in 1991 through the merger of Pacific-Presbyterian Medical Center and Children’s Hospital of San Francisco, CPMC has been affiliated with Sutter Health since 1996 and currently has four medical campuses in San Francisco: Pacific in Pacific Heights, California in Presidio Heights, Davies in the Duboce Triangle, and St. Luke’s in the Mission.

But CPMC’s longtime goal was to build a facility intended to be like the Mayo Clinic of the West Coast, a 15-story, 555-bed full-service hospital and specialty care facility at the corner of Van Ness Avenue and Geary Boulevard. Company officials have made approval for that project conditional on keeping St. Luke’s open in the face of the state’s deadline on seismic safety standards that the hospital doesn’t now meet.

“St. Luke’s Hospital was the big issue that got our attention,” Le Tim Ly, lead organizer for the Chinese Progressive Association, told the Guardian. His group has worked with residents in the city’s southeast sector around environmental justice, air quality, and pollution issues when they became aware of the threat to St. Luke’s. “All this, coupled with efforts to downsize Luke’s, left us alarmed by the disproportionate impact on an already impacted area.”

But alarm over CPMC’s plans has now revived the idea of healthcare planning.

 

MAKING A PLAN

As recently as the beginning of November, representatives for the Hospital Council of Northern and Central California — whose members include CPMC, Chinese Hospital, Jewish Home, Kaiser Permanente, Laguna Honda, St Luke’s, St. Mary’s, San Francisco General Hospital, and Veterans Affairs Medical Center — seemed opposed to any change in the way healthcare planning is done in San Francisco.

At a Nov. 1 hearing on the Campos legislation at the board’s Land Use and Economic Development Committee, Ron Smith, the Hospital Council’s senior vice president for advocacy, said his organization favored maintaining the city’s current procedures. “We would like to propose that the Health Commission does the planning, the Planning Commission does the land use, and that there is a required determination process which is in the current legislation,” Smith said. “We’re proposing that that continue.”

But two weeks later, after Campos amended his legislation so projects now in the planning pipeline are exempt from having to comply with the city’s health care services master plan, some members of the Hospital Council seemed to have a change of heart.

CPMC’s Chief Executive Officer Warren Browner surprised just about everybody when he publicly stated in mid-November that CPMC supports health care planning. “We strongly support the efforts of the city — we are in favor of health planning,” Browner said at a Nov. 15 hearing on the legislation.

“That statement was extraordinary,” said Lucy Johns, recalling CPMC’s history of resisting government control. “The conversation about this legislation has already changed the discourse, at least in public.”

Linda Schumacher, chief executive officer of Chinese Hospital, a community-owned, not-for-profit facility, explained at the same hearing that her organization had been concerned that Campos’ legislation would affect her hospital’s ability to move ahead with a $150 million project that has been in the pipeline since 2003.

“We thank you for that amendment that allows the effective date to be changed,” she said.

“It shows how much progress had been made, even before this legislation goes into effect,” Campos said of the hospital industry’s apparent shift in attitude. “It’s a monumental step, something that was not expected as recently as a few months ago.”

But Ly of the Chinese Progressive Association said he believes the Hospital Council still doesn’t want to see the city getting involved. “As recently as a month ago, their folks were speaking out against any kind of legislation. But I think they started seeing the writing on the wall.”

Ly fretted about the potential negative impact of Campos’ last-minute amendments. Sup. Campos’ plan represents a victory. But we could use that information as soon as possible. The 2013 deadline means the city will be handicapped: it will have information it can’t use yet.”

Ly ventures that the hospital industry’s approach will be to try to lessen the impact of the legislation. “As written, it still provides the Planning Commission and the board with the discretion to approve projects,” Ly said. “Ultimately, the struggle is about values. Just because there are plans and guidance doesn’t mean the healthcare needs of the community will become a top priority — it just provides us with tools to make an assessment.”

Campos counters that his bill will allow the city to create incentives for, and apply pressure on, the hospital industry. “If they truly want their projects to be expedited and approved before state-mandated seismic retrofitting deadlines kick in, they’ll propose plans that work for the community,” Campos explained.

But even as it publicly vows to be supportive, the Hospital Council continues to express concerns about the Campos legislation. “It’s the council’s job is to be supportive now that the board has approved Campos’ plan,” Smith said. “And Sup. Campos was very generous. He started talking to us in June. But we really didn’t get a handle on his proposal until much later. We think the idea of healthcare planning is very good. We still have concerns about the process, but now the board has voted on the legislation, our goal is to do our best to work with the law.”

Concerns that the legislation would be used to mire projects in repeated appeals and give too much weight to critics’ concerns was raised at the Nov. 16 hearing by Sup. Sean Elsbernd.

“Right now, if anyone has concerns, there’s a conditional use process and a CEQA [California Environmental Quality Act] process,” Elsbernd told the Guardian. “But this turns up a brand new appeal. It means the appeals are heard at the same time, but you’ve now created a third route.”

Campos responded to these concerns by amending the legislation to clarify that the board must act on consistency determination appeals at the same time it acts on other related appeals, so projects won’t be delayed.

Evidently this wasn’t enough to appease the San Francisco Chamber of Commerce. “We cannot be supportive of that piece of legislation,” Rob Black, the Chamber’s vice president of public policy, told the Guardian after the legislation was approved. “We believe appeals should be done at the Department of Public Health in conjunction with service providers, since San Francisco provides 20 percent of service, and private organizations provide the remaining 80 percent.”

Black says the Chamber was pleased Campos amended his legislation so as not to slow down projects that are currently in the planning pipeline. But he claimed Campos’ legislation could actually limit access to healthcare services. “The Chamber is concerned that Campos’ legislation will make it harder for doctors to pool together in pods, and if we don’t do that, it won’t make healthcare more available because services will be more expensive,” Black said. “But we absolutely think” the city should analyze gaps in providing health care to San Franciscans.

Campos’ aide Hillary Ronen confirmed that Black is correct in saying that anyone can appeal a hospital project’s consistency determination. “But the final analysis will revolve around asking if the proposed project meets the health care needs of San Francisco,” she said. “If it doesn’t, and the board doesn’t believe there’s a compelling public policy reason to approve the project, [the board] can override the approval.”

 

PATIENTS VS. PROFITS

Mary Michelucci, a registered nurse for 40 years and a member of the California Nurses Association, is hopeful that Campos’ legislation will rein in the hospital industry.

“I hope that any plan that would favor patient care over profit would be the way to go,” Michelucci said. “Running a hospital is expensive. But with the profits that Sutter and CPMC are making, they can afford this.”

Michelucci says the dispute over St. Luke’s came to a head three years ago, when nurses began to suspect that CPMC was planning to let the facility fail, suspicions that intensified when CPMC closed St. Luke’s neonatal intensive care unit 18 months ago.

“Now the babies who need neonatal special care are transported to CPMC’s California campus, which is in the Richmond,” Michelucci said. “But the moms may be discharged and most of them live in the Mission or Bayview-Hunters Point.”

Michelucchi still fears that CPMC will wage “a horrific campaign” against the California’s Nurses Association as it continues to push the plan for its megahospital. “CPMC wants to be in complete control of the registered nurses,” she said. “We, unfortunately, are their conscience, while they are a business model in the business of healthcare. The decisions they make about healthcare are not in the interests of patients or nurses, and we are the thorn in their side.”

All this is happening against the backdrop of the worst economic recession since the Great Depression, and for construction workers facing high unemployment rates in San Francisco, CPMC’s megaproject clearly represents light at the end of a very dark tunnel.

“CPMC is my future,” William Hestor, a 28-year-old father of two and member of SEIU-United Healthcare Workers, said at the Nov. 15 hearing. “We worked hard on a contract and we just want to make sure our hospital is built on time.”

CPMC media spokesperson Kevin McCormack told the Guardian that the real issue between CPMC and the CNA is union membership at CPMC’s Cathedral Hill facility. “CPMC is reducing beds at St. Luke’s because the beds aren’t in use, but the facility will be able to take care of 90 percent of patients’ needs and if you need specialist care, a shuttle will take you to Cathedral Hill,” McCormack said. “This centralized arrangement is the best way to attract the best staff and equipment.”

McCormack noted that there are union members and 1,200 nonunion nurses working at CPMC facilities in San Francisco. “We are bringing together nonunion and union nurses together at this facility, and we don’t feel we have the right to force our nonunion nurses to join,” he said, adding that since the Teamsters, the Carpenters, and SEIU-United Healthcare Workers (UHW) are already unionized at the Pacific and California campuses, they’ll be allowed to unionize at Cathedral Hill.

CNA member Eileen Prendiville, who has worked in San Francisco as a registered nurse for decades, recalls the negative changes she has already seen at CPMC’s facilities, including eliminating registered nurses and specialty services.

“If you pull services, as they have, of course you’ll have fewer patients. And the physicians start leaving, so it’s a vicious cycle,” she said. “St. Luke’s was a small community hospital but now it’s all about corporate medicine.”

Sup. Eric Mar sided with those seeking to exempt current projects from the city’s health care services master plan. But Sup. Sophie Maxwell noted that the Planning Commission will take a facility’s historical role into account in determining whether projects are consistent with the city’s health care services plan.

“We believe that addressed community concerns,” Maxwell said. “St. Luke’s would never have been targeted for closure had this legislation been on the books in the past.”

Campos insists his legislation is not simply about CPMC. “Ultimately this legislation stems from a number of pleas we have heard in the last couple of years from people throughout the city,” he said. “It takes the institutional master planning process to the next level. We have tried to consolidate the appeal process under existing law. Important as the legislation is, it’s key to make sure we have the right master plan because that’s where the heavy lifting will take place.”

Meanwhile, the final EIR is being completed for the CPMC project, which should go before the Board of Supervisors for approval early next year.

Questions for the next mayor

EDITORIAL The progressives on the Board of Supervisors are a long way from united on a possible mayoral candidate, and if they can’t come together, the person who finishes Gavin Newsom’s term will be a compromise candidate, either a short-term caretaker (not the greatest option) or someone who’s more in the moderate camp but a candidate the left can work with — for 2011 and possibly four years after that.

We’re glad to see the proposal by Sup. John Avalos to begin the mayoral selection process early. Picking a mayor in a mad scramble on the day Newsom steps down is a recipe for chaos — and potentially a bad outcome. And as the process begins, the last thing the city needs is a mayor chosen through a backroom deal.

But it’s entirely appropriate for progressive board members to set some standards and to ask the people who are angling for the job to make clear exactly what their positions would be on key policy issues.

In other words, anyone who wants to be the interim mayor — and possibly mayor for the next five years or longer — should have to answer, directly and without hedging, question like these:

How much new revenue does San Francisco need to solve its budget problems, and where, specifically, should it come from? This is the central issue facing the city, now and for the indefinite future. San Francisco’s budget has a structural deficit of at least $250 million, and it simply can’t be closed by cuts alone. What taxes will you pledge to support — and put political capital and fundraising clout behind when they go on the ballot?

What specific programs ought to be cut? Everyone likes to talk about the city living within its means, but that ends up leading to a series of death-by-1,000-cuts decisions that year after year devastate services to the poor. Don’t tell us you need to look at budget figures and work it out later; the big-ticket items are no secret. What’s on the chopping block — and what isn’t?

Will you work to promote public power? How will you expedite community choice aggregation, and will you support a ballot measure to replace Pacific Gas and Electric Co. with a full-scale municipal electric utility?

What are your law enforcement priorities? If money’s tight, should the San Francisco police be hassling nightclubs, or should more resources go into the homicide division? How important are foot patrols, and which neighborhoods should get them? Will the SFPD and juvenile authorities continue to turn young people over to federal immigration authorities?

Who should pay to fix Muni? Should the burden of paying for the transit system fall primarily on the riders (through fare increases and reduced services) or should big downtown businesses and retailers (the major beneficiaries of the system) pay more? Should car owners pay higher fees (including parking fees and congestion management fees) to subsidize transit? Which specific fees would you be willing to push for?

Who should the city build housing for? Right now, much of the new housing stock is aimed at the very rich — and San Francisco is turning into a bedroom community for Silicon Valley. Would you set housing policy to conform with the city’s General Plan assertion that more than half of all new housing should be below market rate? How would you make that balance happen? Should the city spend a significant amount of money for affordable housing, and who should pay for it?

Do you agree that public sector jobs are as important as private sector jobs in San Francisco? Would you support the tax plan proposed by Sup. David Chiu?

Do you support giving the supervisors appointments to all major commissions?

Do you think the city should be doing more to stop TICs and condo conversions and to preserve existing rental housing?

That’s just the beginning of a long list of questions — but the progressives on the board should make sure they have answers before agreeing to support anyone, as a caretaker or interim mayor.

“The Master Switch: The Rise and Fall of Information Empires”

Questions for the next mayor

 The progressives on the Board of Supervisors are a long way from united on a possible mayoral candidate, and if they can’t come together, the person who finishes Gavin Newsom’s term will be a compromise candidate, either a short-term caretaker (not the greatest option) or someone who’s more in the moderate camp but a candidate the left can work with for 2011 and possibly four years after that.

We’re glad to see the proposal by Sup. John Avalos to begin the mayoral selection process early. Picking a mayor in a mad scramble on the day Newsom steps down is a recipe for chaos and potentially a bad outcome. And as the process begins, the last thing the city needs is a mayor chosen through a backroom deal.

But it’s entirely appropriate for progressive board members to set some standards and to ask the people who are angling for the job to make clear exactly what their positions would be on key policy issues.

In other words, anyone who wants to be the interim mayor and possibly mayor for the next five years or longer should have to answer, directly and without hedging, question like these:

How much new revenue does San Francisco need to solve its budget problems, and where, specifically, should it come from? This is the central issue facing the city, now and for the indefinite future. San Francisco’s budget has a structural deficit of at least $250 million, and it simply can’t be closed by cuts alone. What taxes will you pledge to support and put political capital and fundraising clout behind when they go on the ballot?

What specific programs ought to be cut? Everyone likes to talk about the city living within its means, but that ends up leading to a series of death-by-1,000-cuts decisions that year after year devastate services to the poor. Don’t tell us you need to look at budget figures and work it out later; the big-ticket items are no secret. What’s on the chopping block and what isn’t?

Will you work to promote public power? How will you expedite community choice aggregation, and will you support a ballot measure to replace Pacific Gas and Electric Co. with a full-scale municipal electric utility?

What are your law enforcement priorities? If money’s tight, should the San Francisco police be hassling nightclubs, or should more resources go into the homicide division? How important are foot patrols, and which neighborhoods should get them? Will the SFPD and juvenile authorities continue to turn young people over to federal immigration authorities?

Who should pay to fix Muni? Should the burden of paying for the transit system fall primarily on the riders (through fare increases and reduced services) or should big downtown businesses and retailers (the major beneficiaries of the system) pay more? Should car owners pay higher fees (including parking fees and congestion management fees) to subsidize transit? Which specific fees would you be willing to push for?

Who should the city build housing for? Right now, much of the new housing stock is aimed at the very rich and San Francisco is turning into a bedroom community for Silicon Valley. Would you set housing policy to conform with the city’s General Plan assertion that more than half of all new housing should be below market rate? How would you make that balance happen? Should the city spend a significant amount of money for affordable housing, and who should pay for it?

Do you agree that public sector jobs are as important as private sector jobs in San Francisco? Would you support the tax plan proposed by Sup. David Chiu?

Do you support giving the supervisors appointments to all major commissions?

Do you think the city should be doing more to stop TICs and condo conversions and to preserve existing rental housing?

That’s just the beginning of a long list of questions but the progressives and other supervisors  on the board should make sure they have answers before agreeing to support anyone, as a caretaker or interim mayor.

One of the many fascinating pieces of data to emerge in the discussion about Sup. John Avalos’ proposal to mandate local hiring is a recently published analysis of the characteristics of construction workers whose primary workplace is San Francisco.

In October, L. Luster & Associates published a labor market analysis, using data from EDD payrolls and the U.S. Census American Community Survey, that shows there were 14,629 construction workers employed in San Francisco in June 2010. And that five trades currently dominate this workforce and constitute more than 75 percent of the total numbers of construction workers employed in the city.

Carpenters are the biggest group (4,623 workers) followed by construction laborers (2,796 workers) painters (1,459 workers), electricians (1,119 workers) and plumbers, pipe fitters and steamfitters (1,023 workers).

But while this population shows racial diversity (whites and Latinos each make up about 40 percent of the workforce, followed by Asians and Pacific Islanders at 17 percent) African Americans and women each account for only 3 percent of this market. In other words, only 440 African Americans and 405 women were construction workers in June 2010, compared to 5,830 Latinos, 5673 whites, 2,528 Asians and Pacific Islanders.

So, how do these ethnic percentages compare with San Francisco’s overall distribution?
 “Latinos make up a considerably larger portion of workforce than they do the overall population (40 percent of construction workforce v. 13 percent of city’s population),” the Luster report states. “ All other major racial categories constitute a smaller portion of the construction workforce than they do of the total population: Whites (39 percent of construction workforce compared to 49 percent of city population overall) followed by Asian and Pacific Islanders (17 percent compared to 28 percent overall) and African Americans (3 percent compared to 6 percent overall.)

(That last statistic should be a shocker: What?! Only six percent of San Francisco’s current residents are African American?! But the city produced a report two years that detailed the “black out migration” –but provided little money or authority to help follow through on the report’s various recommendations).

Meanwhile, Luster’s report concludes that, “the main imbalance between the employed construction workforce and the San Francisco population lies with the gender distribution. Women comprise only 3 percent of the 14,629 construction workers in San Francisco, whereas they account for nearly half of the overall population.”

Next up in the Luster report was the question of residency. And according to its findings, only 39 percent of workers employed in San Francisco’s construction industry call the city and county of San Francisco their home.

San Mateo County is home to 18 percent of this workforce, Alameda County accounts for another 17 percent, Contra Costa County is home to 13 percent, Sonoma and Marin each are home to 8 percent, and Napa and Solano County each account for a further 5 percent.

These numbers are significant in a number of ways. For instance, 2, 636 workers commute in from San Mateo, 2,418 from Alameda, 1,929 from Contra Costa, 1,197 from Sonoma and Marin, and 773 workers from Napa and Solano, all of which adds up to wear and tear on roads, impacts on air quality, and increased levels of greenhouse gas generation (depending on whether these workers take public transit, car pool or drive the freeways solo, of course).

It also means that when communities oppose aspects of a local construction project—be it a proposed bridge over Yosemite Slough, or a proposed mega-hospital on Cathedral Hill—they are likely to encounter opposition from a workforce that increasingly lives outside San Francisco,  faces a 40 percent unemployment rate, and can be mobilized to show support for these projects, either through showing up physically at meetings or through union dues that can be used to wage political wars with far-reaching percussions for the ability of local residents to influence local land use and economic development decisions.

So, why do so many construction workers live outside San Francisco? The obvious reasons are their relatively low income levels and their related inability to afford housing in the city.
According to Luster’s report, “nearly 33 percent of these workers report earnings of less than $30,000 per year” (based on data that incorporates union and non-union workers, and part-time workers).

Another way of looking at this is to study Luster’s analysis of construction workers who currently live in San Francisco.

“From EDD payroll data and from historic employment relationships between San Francisco, San Mateo, and Marin counties, we estimate there were 7,855 construction workers residing in San Francisco and who were employed as of June 2010—roughly 1 percent of total residents in the city,” Luster reports.

The Luster report also notes that the same five trades make up an even higher proportion of the resident employed construction workforce than they did the total employed construction workforce in the city (86 percent v 75 percent). But now the top two places are reversed: Construction Laborers is the largest trade with 2,442 workers, followed by Carpenters (1,914 workers), Painters (1,122 workers), Electricians (814 workers) and Plumbers (484 workers).

The ethnic distribution of these resident workers is also diverse. Whites (34 percent,) Latinos (31 percent), Asians and Pacific Islanders (30 percent, which is considerably higher than for the overall workforce employed in San Francisco) and African Americans (5 percent).

But women, once again, make up only 3 percent of residents in construction employment.

The Luster report takes the analysis one step further by looking at age distribution. This criterion reveals that the white resident construction workforce is aging, as is the Asian resident construction workforce, though to a lesser extent.

“By contract, the Latino workforce is concentrated among the younger age groups, particularly among the 25-34 age group,” Luster notes. “Of note, 47 percent of the resident San Francisco construction workforce is over the age of 45. Moreover, 23 percent is already 55 years and older. Currently, the number of workers aged 55-64 is 1,544 and declines to 264 for workers aged 65 and older, dropping from 20 percent of the workforce to 3 percent. If construction workers continue to leave the sector in the same proportions by the time they reach 64, a sizeable number of new openings will be created.”

The report, which goes into detailed breakdowns of apprentices (each of the four largest ethnic groups have almost equal shares, and women have 10 percent), the construction trades (which has a greater participation of white workers) and journey people, also gets into workforce projections (the bulk of the jobs generated by the city’s Capital Plan will be generated within the first five years) local hire programs and policy issues. Locals for hire

It’s no secret that San Francisco’s construction industry is going through hard times, a situation that translates into lost opportunities for working class San Franciscans. But that bad situation is being made worse by contractors on local projects hiring workers from outside the city.

Recent studies reveal that under the city’s First Source program, which requires contractors to make “good faith efforts” to reach the goal of hiring 50 percent of their workers from within the city, San Francisco has failed to meet its goals on publicly funded projects.

Sup. John Avalos has introduced legislation that seeks to address this shortfall by requiring contractors to meet the city’s hiring goals or face fines. But some union leaders whose members don’t live in San Francisco are grumbling that the proposal is not workable.

Local unemployed workers are expressing support for the Avalos legislation, as they step up efforts to get UC San Francisco to commit to local hiring plans at its $1.5 billon Mission Bay hospital construction site, which lies a Muni T-Third ride away from some of the city’s most economically distressed neighborhoods.

And now everyone is anxiously wondering where Mayor Gavin Newsom will land on the legislation and on UCSF’s hiring goals in what may be his last weeks as chief executive of San Francisco.

As of press time, Newsom was running neck-to-neck with Abel Maldonaldo in the lieutenant governor’s race, leaving voters uncertain whether Newsom will be mayor in January or second-in-command statewide — a promotion that would land him a seat on the UC Board of Regents but shift his primary allegiance from the City and County of San Francisco to the entire state of California.

When Avalos stood outside City Hall last month and announced his proposal to mandate local hiring on publicly-funded construction projects, he was joined by Sups. Sophie Maxwell and David Campos, Board President David Chiu, community advocates, construction contractors, neighborhood leaders, and union members.

“My legislation will ensure that San Franciscans have a guaranteed shot to work on the city’s public works projects and that the local dollars invested in public infrastructure will be recycled back into San Francisco’s economy and local communities,” Avalos said.

Avalos’ legislation came in the wake of two reports confirming that local construction workers were having a hard time getting work. A report that Chinese Affirmative Action and Brightline Defense released in August estimated that only 24 percent of workers on publicly funded sites are local residents.

And a report released by L. Luster and Associates in mid-October, at the behest of the Redevelopment Agency and Office of Economic and Workforce Development, found that only 20 percent of workers hired at 29 publicly funded construction projects in the past year were local residents.

Avalos’ legislation would mandate assessment of liquidated damages against contractors and subcontractors who fail to meet minimum local hiring requirements and establish monitoring, enforcement, and administrative procedures in support of this policy. It would phase in these requirements over three years, starting at 30 percent the first year.

Avalos noted that his legislation was developed through a series of meetings with city agencies, the Mayor’s Office, labor and building trade unions, the environmental community, neighborhood advocates, contractors, local hiring advocates, and unemployed workers. And he vowed to keep the roundtable approach.

Patrick Mulligan, financial secretary of Carpenters Local 22, told the Guardian that his union, whose members are specific to San Francisco, generally supports local hiring. “But there are some general concerns with the legislation,” said Mulligan, who has lived his whole life in San Francisco and got his first job through a local hiring program. “We have standing contractual agreements with contractors, so whatever legislation gets passed, it will have to be meshed with the existing situation. If these were boom times, people might see it differently. But it’s hard times at the union hall.”

Mulligan also lamented the lack of process for the community to vet whether UC has a local hiring plan at construction projects that impact their neighborhood. “But contractors want the best workforce they can get. And in lean times, they can afford to be more selective and don’t necessarily want to include training time on the job,” he said. “But we feel that it’s inappropriate for contractors to bring their entire crew from outside of town.”

Michael Theriault, secretary-treasurer of the San Francisco Building and Construction Trades Council, told the Guardian that Avalos’ legislation was unworkable because construction workers cannot afford housing in San Francisco and too few qualified workers live in the city.

“We take workers from San Francisco into our apprenticeship program constantly, but they get to a certain point in their careers and find that the city builds well on the low-end and the high-end, but doesn’t build workforce housing. So they end up in Antioch, Vallejo, Fairfield, and Modesto, and commute back in,” Theriault said. “That problem has not been addressed by the city, and it’s at the root of why local hiring programs aren’t working.”

Newsom spokesperson Tony Winnicker said the mayor “supports stronger local hire requirements” even as he expressed concerns with Avalos’ proposal. “We’ll continue to work with the supervisors, the building trade unions and the community on legislation that achieves both realistic and legally enforceable local job guarantees for city projects,” he said.

Winnicker noted that the city already supports local hiring through CityBuild and the San Francisco Public Utilities Commission. “But we believe we can do better,” he added.

Avalos, whose legislation is scheduled for a Nov. 8 hearing of the board’s Land Use and Economic Development Committee, said he sees his proposal as a starting point. “We’ll see where it ends up,” Avalos told the Guardian. “We could pass legislation that wants 50 percent local hiring next year, and it would probably get vetoed and it wouldn’t be realistic. So we have to phase it in and make sure we are creating a system that is going to push the trades to be more inclusive of local residents.”

Meanwhile, unemployed workers — some in unions, others not — continue to protest the lack of a local hire plan at UCSF’s $1.5 billion Mission Bay hospital project, which is funded through debt financing, philanthropic gifts, and university reserves.

“We want to make sure folks get trained and everything that’s necessary, so there is no dispute,” Aboriginal Blacks United member Alex Prince said at an Oct. 27 protest at the Mission Bay site. The protest came one month after Newsom wrote to UCSF Chancellor Susan Desmond-Hellmann noting that the hospital was breaking ground “just as continuing high unemployment rates were devastating the city’s most distressed communities,including neighborhoods impacted by the Mission Bay expansion.”

“There are estimates that up to 40 percent of the members of our local construction trade unions are currently out-of-work,” Newsom wrote. “It would be helpful if you could share the commitments that UCSF has made on the issue of local hiring, particularly around employing residents of San Francisco’s most distressed communities in southeast San Francisco, and the results of those efforts to date.” Winnicker said UCSF has not yet responded.

Barbara French, UCSF’s vice chancellor for university relations, told the Guardian that UCSF is working to evaluate hiring needs for phase of the project, talking to the unions, and intends to make its findings public in December.

“We have had a voluntary local hiring policy since 1993,” French said, confirming that in the past 17 years, the university has reached a 12 percent local hire rate on average. “Sometimes it was 7 percent, sometimes it was 24 percent … Our [goal] is to reach a number that is beyond what we reached before but which is realistic.”

Recently French told community-based organizations that UCSF hadn’t signed a contract with the contractor at its Mission Bay hospital project, didn’t have the permits yet, and that the recent community celebrations didn’t mark the start of active construction at the site.

French said general hiring at Mission Bay will begin in December. “We don’t get any city funds at this site, so our commitment is voluntary. But we feel very strongly that we have to reach out,” she said.

Avalos acknowledged that UC is not under San Francisco’s jurisdiction and can’t be compelled to do more local hiring. “But we know that they are doing a critical amount of building and investing taxpayer dollars, and that this land use impacts the surrounding community. So it makes sense that we have local hire legislation and access to serious end-use jobs at the hospital.”

Hey, D2 voters: BOO!!!!

Why are the rich people in District 2 so scared of Chris Daly, Aaron Peskin, and other progressives? Just the hint that a supervisorial candidate like Janet Reilly might have some vague, tangential connection to a (gasp!) progressive is enough send trembles of fear through their delicate nervous systems, and to fill mailboxes with alarmist warnings of dark progressive plots.

“I eat small children,” Daly deadpanned when I asked him about the campaign by candidate Mark Farrell and some of his wealthy venture capitalist buddies – along with moneyed socialite Dede Wilsey, the yacht-loving, renter-hating Thomas Coates, and their Common Sense Voters SF front group – to hurt frontrunner Reilly’s chances by inaccurately claiming she’s somehow Daly’s puppet.

Nevermind the fact that Daly doesn’t support Reilly, and that he wouldn’t even endorse Reilly a few year ago during her Assembly campaign against Fiona Ma when the Guardian and many progressives were supporting Reilly. “Fiona was a better supervisor than Reilly is going to be,” Daly told us, a prediction that I don’t agree with, but one that shows how ridiculous the website, mailers, and doorhangers that claim Daly is “behind Janet Reilly’s agenda” are.

Nonetheless, Mayor Gavin Newsom, who supports Reilly, has sent out two press releases in the last two days claiming that “Janet Reilly opposes Chris Daly’s agenda as much as I do. She has the full support of our city’s greatest moderate leaders and she will be a strong moderate voice on the board.”

Daly, who is amused by this fearful battle of the rich people, couldn’t agree more. “There is no bigger opponent of Daly’s agenda to build more affordable housing in San Francisco than Gavin Newsom and Janet Reilly. Because that’s my biggest issue,” Daly told us. “Apparently they are afraid of affordable housing in D2.”

But Daly isn’t the only boogeyman who strikes terror into the hearts of the residents of Sea Cliff, Pacific Heights, and other wealthy D2 enclaves. Farrell and his ilk also made such a big deal of Reilly’s association with Peskin, who actually is supporting Reilly, that she announced that if Newsom leaves for Sacramento in January, her vote for interim mayor would only go to a moderate who had never served on the Board of Supervisors with any current members, thus eliminating the chance of supporting Peskin.

Although we at the Guardian held our noses and endorsed Reilly as the best of a bunch of bad choices in San Francisco’s most conservative district, we were appalled during her endorsement interview at just how myopically conservative she had become since her Assembly run, when universal health care was her big issue. Listen for yourself here and decide whether she’s planning to be Daly’s minion.

Geez, what exactly are these people so scared of? Perhaps it’s as simple as Lewis Lapham put it a couple weeks ago, when we discussed the political dynamics of big cities: “The rich are afraid of the poor.”

Steve Moss: The big duck goes on and on and on

And so you will remember, from my earlier blog (STEVE MOSS: THE BIG DUCK) that I asked Steve Moss some questions in the critical District 10 race. He answered but ducked the questions, so I put forth the relevant follow up questions. No answer at all. But the blog comments provide some interesting back and forth with Moss supporters and others in the district.  (Yes, I don’t like anonymous comments and I always sign my comments as Bruce and B3.)

Moss told us in the Guardian endorsement interview that he fully supports more sunshine and accountability in non profits. So let’s take him at his word on this one and raise again the questions he has been ducking. PG&E has invested millions of dollars over the past 10 years into Moss, his non profit (and by extension his for profit firm and the Potrero View, which he now owns and uses for his personal and political agenda.)

More, Moss’s non profit collected $1,290,000 in the past three years from the California Public Utilities Commission for energy efficiency projects, according to SF Power’s annual revenues in its 2008 to 20l0 report on its website. Loretta Lynch, former president of the CPUC, explained to us that this money for energy efficiency programs are funded by ratepayers, not utilities, and that PG&E decides each year whether Moss/SF Power gets any of this money and how much. Lynch lives on Potrero Hill.

The report also disclosed that SF Power got $150,000 from the San Francisco Public Utilities Commisson in 2008 and $125,000 in 2009.) Both the CPUC and SF PUC are widely recognized PG&E- friendly bastions. Moss got hundreds of thousands more in previous years since he incorporated his non profit in 2001.  And, according to a statement in the report, Moss is still hustling money from the big polluters in District 10 (from PG&E, Mirant and its power plant and the mayor’s office et al).

This district has been brutalized for decades by PG&E, for starters with the belatedly shuttered Hunters Point power plant and with the still fuming Potrero Hill power plant, and with the concentration of gas pipelines under the district. If elected, Moss would be the first supervisor in memory who would be a direct financial captive of PG&E.

It is only fair to the residents and businesses in his district that Moss explain before election day some basic questions: how much money in total and by year has PG&E invested in him and his non profit and profit businesses? Why has he been secretive about it?
Will he keep hustling PG&E and Mirant for more money if elected? Will he cut his ties to PG&E and the non profit/profit firms and when? How can his constituents trust him considering PG&E’s investments in him?

Other critical questions concern the $250,000 or so investment that the downtown/Chamber/PG&E/real estate/landlord/BOMA gang has made in Moss and his campaign with the full expectation of getting good returns with friendly votes that would most likely be inimical to the interests of his district. Given the huge, unprecedented money gushing into his campaign from commercial landlords, developers, PG&E, and the Chamber gang, how can district residents and businesses trust him on the critical issues of public power, closing down the Potrero power plant, tenant rights, land use, Lennar and other big developments, affordable housing, and protecting the neighborhoods and small businesses?

The critical pre-election question: If Moss can’t answer these key questions fully and forthrightly, and he keeps the Big Duck going, how can he be trusted as a district supervisor?

Full disclosure: I look out from my office window at 135 Mississippi St. at the Potrero Hill power plant, pumping out poisons every minute of every day, courtesy of PG&E and Mirant, and the PUC/City Hall.

The Sit Lie Posse can “liberate” a billboard in 10 minutes

A press release went out yesterday announcing that a group called the Sit Lie Posse had “liberated” six billboards and 60 bus shelters with original artwork in opposition to Proposition L, San Francisco’s proposed sit / lie ordinance. The posters bear three different images, including one featuring a “Gascon-topus,” illustrated with the face of San Francisco Police Chief George Gascon and the body of a gigantic octopus. Gascon is a strong advocate for the ordinance, which would ban sitting and lying down on San Francisco sidewalks.

While members of the posse did not provide a phone number or reveal their true identities, the Guardian did manage to get in touch via email with a spokesperson of the posse, who goes by the name Jim Rawley.

Rawley says he chose his name in honor of the character from John Steinbeck’s The Grapes of Wrath, who manages the utopian Weedpatch camp and treats the impoverished Joad family with dignity and respect. Rawley also reveals the technique the Sit Lie Posse uses to liberate bus-shelter ads, and tells us how long it takes for the crew to put up displays of their artwork throughout the city. A few of our questions and answers appear below.

San Francisco Bay Guardian: Does the Sit Lie Posse have a budget? If so, how much?
Jim Rawley: The Sit Lie Posse is a volunteer group unaffiliated with any electoral campaign. We made our guerrilla ads by hand and paid for our materials out of pocket. It cost us $150 to liberate six billboards and 60 bus shelter ads.

 
SFBG: How long does it take to liberate a billboard? How about a bus shelter ad? Does the posse use wheat-paste?
JR: Our billboards took about 10 minutes and the bus shelters took 2-3 minutes. We accessed the bus shelters using a master key and attached our work with Velcro, the industry standard for bus shelters because of quick, easy insertion. We attached our billboards with wheat-paste. Despite the efforts of Clear Channel and a heavy rainstorm, our bus shelters and billboards are still up.

 

SFBG: The Sit / Lie Posse has created quite a stir. C.W. Nevius writes in this morning’s column: “Opponents are attempting to make a comparison with the civil rights movement in the South in the ’50s and ’60s. Apparently their view is that an unkempt panhandler camping on the sidewalk equates to the Freedom Riders opposing racial discrimination. Weird.” What would you say to Nevius in response?

 JR: We expected that the Chronicle would try to ridicule, belittle and smear our work, especially since C.W. Nevius and his advocacy columns instigated Prop L. In the 1950s and 60s civil rights workers were maligned by the mainstream press, harassed by the police and subject to physical violence. It takes time for social movements to gain legitimacy in the eyes of the state and the corporate media. In their own words, Chronicle columnist C.W. Nevius and Police Chief George Gascon have said that Prop L enforcement would exclude tourists and center on the homeless. Regardless of your opinion on homelessness, it’s clearly discrimination when the law is based upon a person’s appearance and applies only to certain groups – the poor and people of color. Even more so when the stated intent of the enforcement is to drive certain people out of a neighborhood. This is San Francisco’s kindler, gentler version of Jim Crow segregation.

 

SFBG: What was the inspiration behind the Gascon-topus?

JR: We came up with the Gascon-topus as a reference to sci-fi movie posters. Prop L will give unchecked power to the police to conduct unconstitutional searches and arrests. In the face of such a monstrous attack on civil liberties, we wanted to respond with wit, humor and satire.

 

SFBG: Why do you think it’s important to fight against expanded policing in public space?

JR: It’s important to fight additional policing in pubic space to preserve our civil liberties and to save the character of San Francisco. Most San Franciscans don’t want to sacrifice the city’s diversity and rebellious creativity in order to recreate San Francisco as one massive, sanitized shopping mall with all action controlled by the police. Most San Franciscans don’t want undocumented immigrants and day laborers to be deported after a bogus bust for sitting. Most people don’t want to see the poor disqualified from government housing because they committed the crime of sitting. Most people don’t want to be subjected to unconstitutional drug searches after being detained for sitting, nor do people want to see parolees sent back to prison for the crime of sitting. Public space and civil liberties are vital to a healthy democracy. Public space is the only area beyond private property and the marketplace where San Franciscans can come together to exercise civil rights and collectively shape the future of the city. We need to defend that space and extend it against threats from wealthy business interests and their allies in government.

With the general election just days away, campaign disclosure reports show that downtown interests are spending huge amounts of money to create a more conservative San Francisco Board of Supervisors and to pass Proposition B, Public Defender Jeff Adachi’s effort to make city workers pay more for their pensions and health insurance.

Much of the spending is coming from sources hostile to programs designed to protect tenants in the city, including rent control and limits on the conversion on rental housing units to condominiums. An ideological flip of the board, which currently has a progressive majority, could also have big implications on who becomes the next mayor if Gavin Newsom wins his race for lieutenant governor.

At press time, downtown groups were far outspending their progressive counterparts through a series of independent expenditure committees, most of which are controlled by notorious local campaign attorney Jim Sutton (see “The political puppeteer,” 2/4/04) in support of supervisorial candidates Mark Farrell in District 2, Theresa Sparks in District 6, Scott Wiener in District 8, and Steve Moss in District 10.

Prop. B has also been a big recipient of downtown’s cash, although labor groups have pushed back strongly with their own spending to try to kill the measure, which is their main target in this election.

But the biggest spender in this election appears to be Thomas J. Coates, 56, a major investor in apartments and mobile homes and a demonstrated enemy of rent control. He alarmed progressive groups by giving at least $250,000 to groups that support Farrell, Sparks, Wiener, Moss, and Prop. G, legislation that Sup. Sean Elsbernd placed on the ballot to cut transit operator wages and change Muni work rules.

Although Coates declines to identify with a political party on his voter registration, he donated $2,000 to President George W. Bush in 2004. More significantly, he was the biggest individual donor in California’s November 2008 election, when he contributed $1 million to Prop. 98, which sought to repeal rent control in California and limit the government’s right to acquire private property by eminent domain.

Coates, who is also a yachting enthusiast and sits on San Francisco’s America’s Cup Organizing Committee (ACOC), donated $100,000 on Oct. 20 for Farrell, $45,000 for Sparks, $45,000 for Moss, and $10,000 for Wiener through third-party independent expenditure committees such as the Alliance for Jobs and Sustainable Growth.

The group has already received thousands of dollars in soft money from the San Francisco Police Officer’s Association, the Building Operators and Managers Association, the Golden Gate Restaurant Association, and SEIU-United Healthcare Workers, which supports a high-end hospital and housing complex on Cathedral Hill.

Those downtown groups have spent close to $200,000 on English and Chinese language mailers and robo calls in support of Sparks, Wiener, and Moss in hopes of securing a right-wing shift on the board.

Progressive groups including California Nurses Association, the San Francisco Tenants Union, and the SF Labor Council have tried to fight back in the supervisorial races. While downtown groups spent more than $100,000 promoting Sparks in D6, labor and progressive groups spent $13,000 opposing Sparks and $72,000 supporting progressive D6 candidate Debra Walker.

In D8, progressive groups that include teachers, nurses, and transit riders have outspent the downtown crowd, plunking down $40,000 to oppose Wiener and $90,000 to support progressive candidate Rafael Mandelman. So far, downtown groups have spent about $100,000 to support Wiener.

But in D10, the district with the biggest concentration of low-income families and communities of color, downtown interests spent $52,000 supporting Moss and $5,000 on Lynette Sweet while the Tenants Union was only able to summon $4,000 against Moss. The SF Building and Construction Trades Council spent $4,000 on Malia Cohen.

But that’s small potatoes compared to what downtown’s heavy-hitters are spending. The so-called Coalition for Sensible Government, which got a $100,000 donation from the San Francisco Association of Realtors, has already collectively spent $96,000 in support of Sparks, Wiener, Moss, Sweet, Rebecca Prozan in D8, Prop. G and Prop. L (sit-lie) and to oppose Prop. M (the progressive plan for police foot patrols) and Prop. N (a transfer tax on properties worth more than $5 million).

The Coalition for Responsible Growth, founded by Anthony Guilfoyle, the father of Mayor Gavin Newsom’s ex-wife, Kimberly Guilfoyle (who now works as a Fox News personality), has received $85,000 from the Committee on Jobs, $60,000 from the Realtors, and $35,000 from SF Forward. It has focused on spending in support of Prop. G and producing a voter guide for Plan C, the conservative group that supports Sparks, Wiener, Sweet, and Moss

Coates’ donations raise questions about his preferred slate’s views on tenant and landlord rights. A principal in Jackson Square Properties, which specializes in apartments and mobile homes, Coates is the founding partner of Arroya & Coates, a commercial real estate firm whose clients include Walgreens, Circuit City, and J.P. Morgan Investment Management. In 2008, when he backed Prop. 98, Coates told the San Francisco Chronicle that rent control “doesn’t work.”

Ted Gullicksen, director of the SF Tenants Union (SFTU), which has collectively spent $30,000 opposing Sparks, Wiener, and Moss, is disturbed that Coates spent so much in support of this trio.

“Coates was the main funder of Prop. 98,” Gullicksen explained. “His property is in Southern California. He’s pumping a lot of money into supervisors. And he clearly has an agenda that we fear Moss, Sparks, and Wiener share — which is to make the existence of rent control an issue they will take up in the future if elected to the board.”

That threat got progressive and labor groups to organize an Oct. 26 protest outside Coates’ San Francisco law office, with invitations to the event warning, “Be there or be evicted!”

Sparks, Moss, and Wiener all claim to support rent control, despite their support by someone who seeks to abolish it. “I answered such on my questionnaire to the SFTU, which chose to ignore it,” Sparks told the Guardian via text message. “In addition, I’ve been put out of apartments twice in SF, once due to the Ellis Act. They ignore that fact as well.”

Records show that in May 2009, Moss — who bought a rent-controlled apartment building near Dolores Park in D8 for $1.6 million and he lived there from the end of 2007 to the 2010, when he decided to run for office in D10 — served a “notice to quit or cure” on a tenant who complained about the noise from Moss’ apartment. Ultimately, Moss settled without actually evicting his tenant.

“I read about Coats’ [sic] contribution in Bay Citizen,” Moss wrote in an e-mail to the Guardian. “This donation was made to an independent expenditure committee over which I have no control and almost no knowledge. I have stated throughout the campaign, and directly to the Tenants Union, that I believe current rent control policy should remain unmolested.”

But Moss is with downtown on other key issues. He supports Newsom’s sit-lie legislation and the rabidly anti-tenant Small Property Owners Association, whose endorsement he previously called a “mistake.”

Yet Moss, who sold a condo on Potrero Hill in 2007 for the same price he paid for the entire building in 2001, seems to voice more sympathy for property owners than renters, who make up about two-thirds of city residents. He told us, “Landlords feel that they are responsible for maintaining costly older buildings and that they are not provided with ways to upgrade their units in ways that share costs with tenants.”

Another realm where downtown seems to be trying to flip the Board of Supervisors on a significant agenda item is on health care, particularly the California Pacific Medical Center proposal to build a high-end hospital and housing project on Cathedral Hill in exchange for rebuilding St. Luke’s Hospital in the Mission.

The project has divided local labor unions. UHW supports the project and a slate of candidates that its parent union, Service Employees International Union, is opposing through SEIU Local 1021, which is supporting more progressive candidates. The California Nurses Association also opposes the project and candidates such as Wiener who back it.

“A recent mailer by CNA falsely says that CPMC is closing St. Luke’s and Davies,” CPMC CEO Warren Browner recently complained in a letter to the Board of Supervisors. “We are not. We are committed to building a state-of-the-art, high-quality replacement hospital at St. Luke’s and continuing to upgrade Davies.”

But the CPMC rebuild is contingent on the board approving the Cathedral Hill project. So the CNA mailer focused on what could happen if the city rejects the CPMC project: “We could lose two San Francisco hospitals if Scott Wiener is elected supervisor.”

SEIU-UHW’s alliance with downtown groups and its use of member dues to attack progressive candidates places it at odds with SEIU Local 1021 and the SF Labor Council, which has endorsed Janet Reilly in D2, Walker in D6, Mandelman in D8, and Cohen (first choice) and Chris Jackson (second choice) in D10.

“We’re really disappointed that there are labor organizations that feel they have to team up with Golden Gate Restaurant Association, which is against health care [it challenged the city’s Healthy San Francisco program all the way to the U.S. Supreme Court], and with CPMC, which is working to keep nurses from joining a union,” Labor Council Director Tim Paulson said. “This alliance does not reflect what the San Francisco labor movement is about.”

Paulson said that the Labor Council values “sharing the wealth … So we don’t want Measure B [Jeff Adachi’s pension reform] or K [Newsom’s hotel tax loophole closure, which has a poison pill that would kill Prop. J, the hotel tax increase pushed by labor] or L [Newsom’s sit-lie legislation],” Paulson said.

CPMC’s plan is headed to the board in the next couple months, although Sup. David Campos is proposing that the city create a health services master plan that would determine what city residents actually need. Hospital projects would then be considered based on that health needs assessment, rather than making it simply a land use decision as it is now.

Moss told the Guardian that UHW endorsed him because of his positions on politicians and unions. “I agreed that politicians should get not involved in union politics,” Moss said. “The United Healthcare Workers seem to be a worthy group,” he added. “All they said was that they wanted to make sure that they had access.”

But CNA member Eileen Prendiville, who has been a registered nurse for 33 years, says she was horrified to see UHW members recently oppose Campos’ healthcare legislation. “I was shocked that they were siding with management,” she said.

Prendiville believes UHW is obliged to support CPMC’s Cathedral Hill plan, which is why it is meddling in local politics. In his letter to the board, Browner noted that his company and its parent company, Sutter Health, can’t legally do so directly. “The fact is that CPMC and Sutter Health are 501(c)(3) not-for-profit, nonpartisan organizations, and we neither endorse nor contribute to candidates,” Browner wrote.

“When UHW settled its contract with its members [as part of its fight with the rival National Union of Healthcare Workers], they had to publicly lobby for Cathedral Hill,” Prendiville claimed.

SEIU 1021 member Ed Kinchley, who works in the emergency room at SF General Hospital, is also furious that UHW is pouring money into downtown’s candidates and measures. “UHW isn’t participating in the Labor Council, it’s doing its own thing,” he said.

Kinchley said UHW, which is currently in trusteeship after a power struggle with its former elected leaders, is being controlled by SEIU’s national leaders, not its local membership, which explains why it’s aligned with downtown groups that have long been the enemy of labor.

“Sutter wants a monopoly on private healthcare and people like Rafael Mandelman and Debra Walker have been strong supporters of public healthcare,” Kinchley said. “I want someone who can straight-up say, here’s what’s important for families in San Francisco, especially something as important as healthcare. Overcoming a foreclosure, Cohen promises to be a “fierce advocate”

D10 candidate Malia Cohen deserves kudos for publicly confronting rumors that she was facing a foreclosure–and for vowing to be a strong advocate, in future.

“I first addressed the rumors publicly a month ago,” said Cohen, who returned to the topic of her foreclosure earlier this week at a San Francisco Housing Coalition candidate night.

But what Cohen personally told me today not only typifies many of the foreclosure horror stories that have been making national headlines. It also illustrates the abysmal lack of local leadership on this issue–and that’s something that Cohen says she’ll change.

“During the apex of the economic boom, I was the recipient of a predatory loan,” Cohen explained. “I bought a house in the Bayview in 2006 and started the process to modify my home loan. It took one year to get the banks to answer my questions, my paperwork has been lost, and I have a housing counselor I’m working with.”

“Months ago, I got word that my foreclosure has been rescinded and the property is back in my name, so I look forward to being a housing advocate, if elected,” Cohen continued.”Because what the housing crisis has done locally has been to decimate and destabilize our local neighborhoods.”

She notes that 1400 homes have already been lost in the Bayview, and another 1200 are currently teetering on the edge, but so far efforts to reform foreclosure laws have failed in the California legislature.

“Senator Mark Leno proposed SB 1275, which laid out a homeowner’s Bill of Rights, but the bank lobby was too strong,” Cohen said.

‘It’s such a helpless feeling, it’s been a nightmare, “ Cohen continued. “And once again there was no leadership locally to protect our interests, which is another reason why Malia Cohen is in this race. I am going to work hard to advocate on behalf of the community. It’s a crime the amount of money that was transferred out of the Latino and African American community during this crisis. Someone needs to be held accountable.”

On the margins

Franklin is a 20-something computer programmer who shares an apartment with 10 other people around his age, an arrangement that helps him and his housemates come up with $3,500 each month for rent in the Mission, a rapidly gentrifying part of town.

“Everyone is pretty much working, but they are in and out at different times so the house isn’t ever really empty. But there’s usually only three or four of us at a time, ” Franklin told the Guardian, speaking on his cell phone as he rode his bike to work.

But how does an apartment that officially has only one bedroom sleep 10 people? Franklin said there are other rooms in the house — including a dining room and a double parlor that splits into two with sliding doors — and that each of these spaces has a couple sleeping in it. “And there is one person sleeping in a closet and another sleeping in a space atop the bathroom.”

While overcrowding has been a problem in immigrant communities in San Francisco, it’s reaching a new area: young people who have for generations flocked to the city to escape uncomfortable home lives, find a supportive community, and make a new start in life.

Ted Gullicksen, director of the San Francisco Tenants Union, said at least 1,250 housing units annually were lost to condominium and tenancy-in-common conversions in the dot.com and housing bubble years, a loss rate that has slowed only slightly since then.

“Right now, it’s about 1,000 units a year,” he said.

It’s become more common for young people to struggle to pay rent in a town where well-paying jobs are scarce and educational programs have been cut — a triple whammy that means youth with additional challenges are at risk of becoming homeless and getting trapped in vicious cycle of abuse and incarceration.

COMPOUNDING THE PROBLEM

Sherilyn Adams, executive director of Larkin Street Youth Services, which provides housing, medical, social, and educational services to at-risk homeless and runaway youth, says all young people in San Francisco face the same basic challenges.

“And if, in addition, these youth are part of a group like LGBTQ youth, or are youth of color, or immigrant youth, documented or not, then the circumstances and barriers are much more exacerbated,” she said.

Adams said San Francisco has done a lot to add resources for transitional age youth, a group that traditionally has been defined as ages 12 to 24. “But there is still a significant gap in resources, especially for the more disenfranchised groups, because the longer you’ve been on the street, the more complex your issues in terms of substance abuse and mental health.”

Civic leaders, including California Assembly member Tom Ammiano, recently held a rally and candlelight march to raise awareness of the tragic rise in homelessness and suicides among LGBTQ youth. Shortly after, Adams told us, “Youth who came here escaping homophobia in their family or city then face the harsh reality of San Francisco.”

Adams understands that some people see Proposition L, legislation on the November ballot to criminalize sitting or lying on city sidewalks, as a way to address disruptive and aggressive behavior on the streets. “But it becomes part of the larger divide, because youth who come here and are on the street are mostly there because they have no other place. So penalizing them in the absence of services, housing, and education is ineffective at best and really harmful at worst,” Adams said.

Many young people on the brink of homelessness are “somewhat invisible,” and therefore at high risk, she said. “Youth will double, triple up. They will couch surf as a way to be off the streets. And we hear the stories where youth are faced with a Sophie’s choice: Do you sleep on the street, or do you barter with what you have available so as to get shelter? And LGBTQ youth are at particular risk because the more disenfranchised and disconnected you are, the more you have to make impossible choices to survive.”

Jodi Schwartz, executive director at Lyric, an SF nonprofit that focuses on building community and inspiring change in LGBTQ youth, said the group serves 500 youth and reaches out to 800 to 1,000 more each year. “We go into classrooms and talk about hate speech, putting it in the context of racism and other forms of oppression,” she said.

“There’s a misconception that because we live in San Francisco and have a lot more dialogue and interaction with the LGBTQ community, that young people’s experience here is so much better. It may be different, but I wouldn’t say it’s better,” Schwartz said, noting that harassment levels, especially for transgendered youth in local schools, are very high.

HELPING THOSE IN NEED

Young women are another at-risk group, especially if they are pregnant, have kids, or are in the foster or juvenile justice system.

As executive director of the Center for Young Women’s Development in San Francisco’s gritty SoMa district, Marlene Sanchez tries to stabilize at-risk young women, then engage them in policy work so they can advocate for other young people they know.

“We work with young women who are involved in the underground street economies, doing prostitution, drug sales, and selling stolen goods like clothes,” Sanchez said. “We try to reach them on the streets and inside Juvenile Hall, so we take an inside-outside approach.”

Leajay Harper, who coordinates CYWD’s Young Mothers United program, works with young pregnant women inside Juvenile Hall.

“We have all experienced poverty, parents on drugs, and having to take care of younger siblings,” Harper said. “When young moms get incarcerated, they are at risk of having their children taken away at much higher rates. So we started parenting classes that are age and culturally relevant.”

City records show that while only about 12 percent of Juvenile Hall detainees are female, they are twice as likely as their male counterparts to land back in custody for probation violations.

“There are lots of young women with felonies struggling to pay their bills and feed their kids who look out the window and see they can sell drugs. And that often seems like the only option,” Sanchez explained.

City statistics also show that of the overwhelmingly male population at Juvenile Hall, almost half is African American, and that many are inside for what appear to be gang-related offenses.

Easop Winston, a 35-year-old local musician, church pastor, and member of the Visitacion Valley Peacekeepers, regularly visits young men inside Juvenile Hall, where gangs are a topic of discussion every week.

“The same guys that they have been fighting with, they are now incarcerated with,” Winston observed. “So one of the approaches I try to take is rehabilitating how they think about their neighbor. You are killing/fighting with someone who lives one block over. It’s plain genocide”

He credits the juvenile justice system for doing its best, but worries that it fails to rehabilitate youthful offenders with jobs skills, education, and counseling before sending them back into society.

He blames the churches for not doing a better job of making youth feel welcome. “Churches are part of the fabric of our community,” he said. “They need to do more outreach and not have so many rules. They need to accept youth as they are, with their tattoos, piercings, and styles of clothing.”

Winston believes politicians need to do a better job of making sure community-based organizations deliver on their promises to help working class communities of color. At the same time, as he acknowledges, “We can’t cure the world in one day.”

“Over the last five to 10 years, the African American population in SF has shrunk,” he observed. “Everybody is moving to Antioch and Fairfield because people can’t afford to live here. People are losing their jobs. And San Francisco has almost become impossible to live in unless you have a college degree. A lot of what I hear from youth is about economics. They want jobs. They want to be trained.”

PUSHING THEM OUT

Political disputes over the city’s sanctuary city policies on undocumented immigrants — which have left in limbo the question of whether arrested immigrants will get their days in court before being turned over to the federal government for possible deportation — have also been a source of instability for immigrant teens, many of whom are homeless and/or LGBTQ.

Police Commissioner Angela Chan, a staff attorney with the Asian Law Caucus, decried Mayor Gavin Newsom for refusing to implement Sup. David Campos’ due process legislation, which the board approved in November 2009.

“It’s been a little bit upsetting for the many groups that took the democratic process seriously. But these groups are still very committed to these kids,” Chan said. “We are hoping to work with the new U.S. Attorney Melinda Haag to clarify this issue and explain that the top priority of the Obama administration is not to deport undocumented youth.”

Other so-called tough-on-crime initiatives also threaten local at-risk young people. In September, City Attorney Dennis Herrera secured an injunction against 41 alleged gang members in Visitacion Valley, a strategy that progressives fear will accelerate the ongoing displacement of the African American community.

Court documents show that 66 percent of the men named in the injunction are 18 to 25 years old and that many have children in public housing, where lease holders are predominantly women of color.

San Francisco City College Trustee Chris Jackson, 27, is running for the District 10 seat on the Board of Supervisors. Noting that the southeast SF district has some of the highest numbers of poor people and children citywide, Jackson said that youth issues are similar to challenges that other voters face.

“But the context is different,” said Jackson, who previously served on the San Francisco Youth Commission. “Young people care about safe streets because it’s us or our friends who are on them. We care about schools because we are in them and want to go to college. And we are concerned about the future of employment because how do you tell folks to go to school if there are no jobs?”

Jackson notes that in the Bayview-Hunters Point, home to the city’s largest remaining African American community, kids don’t come back if they leave for college. “We see a brain drain. It’s really difficult to retain young people, so it’s important to first make sure that youth’s housing needs are met. And they also need access to careers so that when they graduate, they know there is a job in the city. But right now, youth can’t even find a summer job because of the recession.”

He called for city policies that are based on the needs of current city residents rather than developers’ profits or the desires of well-off outsiders to move here.

“San Francisco is more of an opportunity for Silicon Valley residents than for youth who were born and raised here. And part of the problem is city policies, ineffective programs, and a failure to provide job opportunities for youth,” he said. “Everything for youth has been gutted.”

And those evaporating opportunities are compounded by punitive policies like Prop. L, Jackson said, further alienating young people. “It comes down to how much money you have,” Jackson observes. “If you are rich, you can enjoy the parks, the clubs, the transit. But if you are low-income, especially low-income youth of color, it’s very hard to take advantage of everything the city has to offer.”

Noting that both City College and the San Francisco Unified School District canceled their summer school program, Jackson said, “it doesn’t look like youth are prioritized.”

Jackson was recently at Double Rock (a.k.a. the Alice Griffith Public Housing Project) and he saw four kids under 10 who were at home while their parents were at work. “Why aren’t they in school or in child care? And don’t give me the line that these are hard to serve communities. We have to serve them.”

N’tanya Lee, executive director of Coleman Advocates, agrees that while all young people are struggling in the city, African American children and youth are having one of the worst times.

“We don’t need 5,000 different strategies and initiatives when 90 percent of these kids live in extreme poverty, mostly concentrated in public housing, and you could fit the city’s entire black high school student population into one auditorium,” Lee said.

She wants the city to create a database of these youth and develop specific strategies to help this population before it’s too late.

“No one in city government feels accountable for the outcomes for black children and youth,” she said. “Instead you have one group who are about young people and another who are about economic development — and they have nothing to do with each other. Meanwhile, we’ve lost half of all black families with children in this city in the past 20 years.”
