It’s a depression. Let’s get cracking

OPINION It’s time we called it what it is: this is a depression. And we need to figure out the politics of the new age we are entering, especially in cities, which will be the ground zero for economic hardship.

While President Obama and the media continue to use euphemisms (the "subprime mortgage collapse," "the recession," "the credit crunch") for fear of causing a panic. But the recent tsunami of lost jobs and frozen credit, coupled with the long-standing structural problems of nearly 30 years of Republican magic-of-the-marketplace economic policies — shrinking real incomes for 90 percent of Americans, an obscenely expensive healthcare system that neither businesses nor workers can afford, and an outmoded and deadly carbon-based energy system — have created a new global depression, one the experts said could never happen again.

The current global depression differs in three important ways from your grandparents’ (or great-grandparents’) depression.

First and foremost, this depression was worldwide from the start. Although made in America, the global financial capital system infected the world economy one trading day after it affected ours. Second, the Great Depression was agricultural- and industrial-based, hitting small towns and the countryside the hardest. The current depression is financial service-sector based, and will hit cities and suburbs the hardest, especially the housing, real estate ,and retail sectors. Since the nation is far more urban than it was in the 1930s, our depression will put far greater strains on our urban politics and life-supporting social services to low income people, than anything that occurred during the Great Depression. Finally and saddest, this depression comes at a time when organized labor is weak, divided, and confused.

San Francisco leaders seem unequal to the challenges confronting us. Recently Mayor Gavin Newsom has come up with the usual policies that transform a bad recession into an even greater depression: cut urban health and human services, lay off city employees, and massively accelerate speculation in condo conversions in the midst of cratering real estate values and zero mortgage lending while providing an anemic stimulus proposal for a handful of small businesses that pay their workers very little and are no longer capable of providing health care.

But in the land of the blind, the one-eyed person is king. What is the progressive answer to these mindless proposals? The usual default answers: no cuts, no layoffs — and silence on all the other issues confronting us. This simply won’t do this time. Its not about the budget, folks, it’s about the economy.

We need to start talking with each other — now — about how we rebuild a sustainable urban economy that runs on renewable energy, provides health care for our people, and houses us all. Lets get cracking. *

A little less than an hour before the Tenderloin Health Resource Community Center is scheduled to open for the afternoon, a line forms outside and stretches down Leavenworth Street. If they arrive early enough at this drop-in center for the chronically homeless, people can get health services or be put on a list for a bed in a homeless shelter. For many, the drop-in center is simply a place to use the bathroom, have a snack, or take refuge from the street.

Once the doors have been unlocked, every seat inside the center is filled. Most clients are African American men. A few are in wheelchairs. One has a hacking cough. The atmosphere feels like a rundown waiting room at a doctor’s office, filled with dispirited patients. Standing quietly near the entrance is a security guard, dressed all in black with a pink mask covering her nose and mouth.

Tenderloin Health is contracted to provide services for 6,000 individual clients per year, according to Colm Hegarty, the organization’s director of resource development. In reality, it serves twice as many.

But it appears that the center’s days are numbered. Its initial city funding of $1 million a year was halved in 2008, Hegarty explained. In the latest round of deep budget cuts — dealt to address next year’s gaping budget deficit — the rest of its funded was eliminated.

While the decision hasn’t been finalized, Hegarty says, the center will likely have to close its doors for good June 30. It’s just one of many San Francisco health and human services programs that will be affected by looming budget cuts, which were mandated by Mayor Gavin Newsom to balance an unprecedented shortfall, projected at more than $500 million for the coming fiscal year, that was triggered by the economic downturn. Newsom, meanwhile, has twice vetoed legislation passed by the Board of Supervisors calling for a special election to ask voters to raise taxes to save programs such as this one.

For the clients of Tenderloin Health, just a stone’s throw from City Hall, the deep cuts have real-life consequences. "The question is going to become where will these people go?" Hegarty wonders.

Brendan Bailey, an occasional client at the drop-in center who says he’s currently staying in a shelter, echoed Hegarty’s concern. "I’d think that they would rather have them here than wandering the street," he said, gesturing toward the center’s crowded waiting room.

Jennifer Friedenbach, executive director of the Coalition on Homelessness, sounded a similar note at a recent Human Services Agency budget hearing, where it was announced that homeless shelters might also be shut during the day in an effort to save money.

"We were basically putting forth this idea that if they’re both going to close the Tenderloin Health and close the shelters during the day, it really ends up being a recipe for disaster in terms of people’s ability to get off the streets," Friedenbach said. "It just would be incredibly problematic … They need to be somewhere."

Another blow to homeless services are cuts to the Mission Neighborhood Resource Center, which operates a program that caters to homeless women. All told, Newsom wants 25 percent slashed from the Department of Human Services budget for the 2009-10 fiscal year. According to a list of proposed reductions presented to the San Francisco Human Services Commission Feb. 12, at least 62 staff positions will be eliminated. That figure doesn’t include layoffs that are taking effect in the next couple months as a response to the current year’s midyear budget adjustments.

Another eliminated component of human services is the agency’s Civil Rights Office, which consisted of two full-time staffers who were responsible for investigating complaints from clients who felt they had experienced some form of discrimination. When the Guardian contacted one of those staff members, she declined to comment but did acknowledge that her position had been written out of the budget.

Steve Bingham, an attorney with Bay Area Legal Aid, notes that state law actually requires the city to have a civil-rights mechanism in place. "The law doesn’t require that there be specific full-time people to do it. The law requires that somebody be designated and that certain work be done," he explained, adding that he’d been told the civil-rights responsibilities would now be shared among several staffers.

"I’m very disturbed that they’re basically going to divvy up responsibilities," he said. "We are constantly bringing to the attention of management in the department deficiencies that are essentially civil rights deficiencies. For example, somebody who just can’t process written information misses a meeting with a worker that he was informed about with a notice. Accommodation means that you figure out that that person needs a telephone call. If you miss a meeting with a worker, you get a notice that you’ve been terminated from benefits."

Human Services Agency executive director Trent Rohrer did not return repeated calls requesting comment about budget cuts.

Meanwhile, in the Department of Public Health, the consequences of deep budget cuts are already taking a heavy toll. Over Valentine’s Day weekend, 93 certified nursing assistants employed at Laguna Honda and SF General hospitals received pink slips, a blow that represents just one of several rounds of layoffs being administered in the wake of midyear budget cuts. (An earlier round, which included 19 CNAs, took effect Feb. 20.) The fallout from budget reductions for the 2009-10 fiscal year won’t take effect until May 1, according to Deputy Controller Monique Zmuda. Everyone the Guardian spoke with expects that round to be worse because there’s a much larger projected deficit.

Ed Kinchley, healthcare industry chair and executive board member of SEIU Local 1021, is employed as a social worker in SF General’s emergency room. He says the cuts have diminished the quality of service the hospital can provide. "Part of my job is trying to hook up the patients who are coming into the emergency room with services, and almost every week when I come into work, there’s some service we have had in the past that isn’t there anymore," he says.

"The biggest thing they’re doing is what we call ‘de-skilling,’" Kinchley continues. "For example, in the first round, they took 45 unit clerks — the clerical people who sit at the centralized desk and make sure the right labs get done and sent to the right place — and replaced them with clerks who don’t have any medical knowledge. That’s at the clinic where all the people go who are supposed to be getting quality care under Healthy San Francisco."

Reassignments are another issue, he says. When an African American nurse was reassigned, she was made to leave her post at a program that offered therapy for youth and adolescents that had suffered sexual abuse. Since many of those clients are African American, Kinchley points out, her removal diminishes the culturally competent service that was previously in place for these youth. Sometimes the new assignments shake up people’s lives: staffers in the process of completing nursing programs who were recently reassigned to completely different work hours, for instance, have had to abandon their studies because of the scheduling conflict.

The end result, in his opinion, is a decline in both the quantity and quality of service at SF General, even in the wake of voters approving a bond measure in the November election to borrow some $887 million to rebuild the facility.

"I have worked there since 1984," Kinchley says. "Right now, morale is lower than I’ve ever seen it."

As the cuts create ripple effects in the lives of health and human services staffers and the clients they serve, a City Hall fight over raising city revenue continues between the Board of Supervisors and the mayor. In the face of opposition from Newsom and the business community, the special election proposed for June 2 has been pushed back to late summer at the earliest.

"I firmly believe that moving forward precipitously with a special election not only puts the success of needed revenue measures at risk, but bypasses our responsibility for finding long-term and enduring budget solutions," Newsom wrote in a Feb. 13 veto letter to the Board of Supervisors.

Labor, meanwhile, continues to advocate for raising city revenues, saying it’s the only way to stave off cuts to the most critical services. A group called the Coalition to Save Public Health, comprised in part of SEIU members, will host a forum called State of the City: Budget Crisis Town Hall to discuss across-the-board cuts (See Alerts for details).

"If the voters of San Francisco are willing to vote for a tax increase — or even if they’re not — if they’re given the opportunity to vote for it, then they’re not going to hold that against [Newsom]," Kinchley says. "The initiative is coming from the Board of Supervisors anyway. All he needs to do is get out of the way."

Notes from the Politics blog

If you’ve been reading the Guardian‘s Politics blog, you know that battles between and within some major California labor unions — including Service Employees International Union, SEIU’s United Healthcare Workers, the newly formed National Union of Healthcare Workers, and the California Nurses Association — are dividing the movement at a crucial time for progressive politics.

From important federal legislation such as the landmark Employee Free Choice Act to state legislation like the single-payer healthcare bill that Sen. Mark Leno plans to reintroduce in the coming months, philosophical and turf battles between unions have hurt labor’s ability to successfully counter corporate power.

"The fight inside SEIU [involving all four unions mentioned above] is one that is going to hurt our ability to pursue and pass legislation important not just to health care workers but workers in general," labor writer David Bacon told the Guardian. "There’s lots of energy going into jurisdictional battles and I think employers will use this fight against us … Sometimes it feels like we’re going backward."

But the battles continue. On Feb. 18, NUHW plans to picket outside UHW’s Oakland offices, protesting SEIU’s efforts to hinder NUHW organizing efforts (which we discuss more online). Philosophical differences between SEIU (which has close relationships with national corporate and political leaders) and unions like NUHW and CNA (which take more adversarial roles with employers and push for fundamental reforms such as single-payer health care) animate the debate.

Meanwhile, even more radicalized unions such as the International Longshore Workers Union have increasingly taken strong stances on immigrant rights and social justice issues like the BART police shooting of passenger Oscar Grant, which they discussed at a Feb. 14 rally that featured UC Santa Cruz professor and activist Angela Davis.

SEIU preaches unity while trying to divide and conquer CNA

Service Employees International Union is caught in the position of decrying efforts by breakaway leaders of the new National Union of Healthcare Workers to steal away SEIU members during a critical moment for the labor movement, while at the same time SEIU is meddling in the internal affairs of another union, California Nurses Association.

On Thursday, CNA blasted SEIU for “impersonating nurses in a multimillion dollar campaign” to topple current CNA leaders and replace them with candidates closer to SEIU and its incremental approach to health care reform. The charges echoed those by Sal Rosselli and other NUHW leaders, who say SEIU under President Andy Stern has sacrificed member interests and rights in its drive become a national powerhouse that works closely with elected officials and large corporate employers.

SEIU spokesperson Michelle Ringuette responded dismissively: “CNA has made wild and untrue charges against SEIU members before. This release is more of the same…It is true that there are CNA members that are unhappy with the direction their union is taking. We have spoken with a number of them, and we support the CNA nurses who want to hold their union’s leaders accountable.”

But the next day, after the Guardian identified SEIU members from other states who have been contacting CNA members in an aggressive campaign to unseat CNA leadership, Ringuette admitted to the campaign, defiantly saying SEIU would do everything in its power to protect its interests.

CNA’s leaders say SEIU’s campaign is illegal. And it certainly belies claims that SEIU leaders have made about the NUHW situation, in which Ringuette and others have repeatedly said union infighting now is major distraction from efforts to pass the landmark Employee Free Choice Act and stave off deep cuts threatened by the dire budget situation in California and its cities and counties.

Labor war widens

On a day when the labor movement rallied in cities across the country in support of the federal Employee Free Choice Act, which would make it easier for employees to form a union, bitter infighting involving the nation’s largest union, Service Employees International Union, also escalated today.
The California Nurses Association today charged SEIU with launching an illegal, multi-million-dollar campaign to take over their organization using what that they call a phony nurses group called RNs for Change to take over the leadership of CNA and affiliate it with SEIU, which calls the accusations “wild and untrue.”
CNA spokesperson Chuck Idelson called SEIU head Andy Stern corrupt and power hungry, echoing criticisms from Stern-ousted United Healthcare Workers leaders who last week formed the new union National Healthcare Workers Union. NUHW spokesperson John Borsos said the new union has now gathered petitions from about 25,000 workers in 101 facilities who want to leave SEIU and join NUHW.

Fallout from the union clash

Fallout from the power struggle between Service Employees International Union and its Oakland-based local, United Healthcare Workers, has been felt particularly strongly in the Bay Area since SEIU took over UHW and ousted its leaders Jan. 27 (see "Union showdown," 1/28/09).

After SEIU replaced UHW head Sal Rosselli and more than 70 elected leaders of that union for defying SEIU demands, Rosselli and his team formally resigned from SEIU Jan. 29 and formed a new union, National Union of Healthcare Workers, hoping to draw thousands of current SEIU members disgruntled with the top-down management style of SEIU head Andy Stern.

It took a few days for SEIU to take physical control of UHW’s Oakland offices, where Oakland police officers were called Jan. 30 to mediate a final showdown between UHW loyalists and the new SEIU management team, which is under the direction of two SEIU executive vice presidents that Stern appointed as trustees: Eliseo Medina and David Regan (see "SEIU seizes last holdout: UHW’s Oakland headquarters," Guardian Politics blog).

"It’s not about the building, it’s about the members," Regan told the Guardian Jan. 30, later adding, "At the end of the day, the members of the union get to decide if they want to be in the union or not be in the union."

And after a weekend when Rosselli said SEIU was aggressively trying to close outstanding contracts with many employers, a move that would make it difficult for members to disaffiliate from SEIU and join NUHW, he filed petitions showing that many members do indeed want to leave SEIU.

"We don’t trust them with our contracts and we don’t trust them with our dues," Shayne Silba, a psychiatric technician with Alta Bates Summit Medical Center in Oakland, told reporters during a Feb. 2 teleconference announcing that about 9,000 workers at 62 medical facilities have filed petitions with the National Labor Relations Board asking to leave SEIU and join NUHW.

Rosselli said that more than 50 percent of workers at most of these facilities signed the petition, and he’s asking SEIU to honor the request and let them go.

The list of facilities includes some prominent Bay Area medical centers such as Children’s Hospital in Oakland, Alta Bates, and California Pacific Medical Center and other entities run by Sutter Health. Sutter has clashed with union members and community leaders over numerous issues, including the future of St. Luke’s Hospital in the Mission District.

"The Sutter Healths of the world are colluding with SEIU just like they did before the trusteeship," Rosselli told reporters, echoing his persistent theme that SEIU is too cozy with employers and doesn’t negotiate good contracts.

SEIU spokesperson Michelle Ringuette disputed that characterization and the accusations that the union was trying to quickly sew up outstanding contracts with employers to forestall moves to NUHW. "There were an astonishing number of contracts left incomplete," she said. "It’s callous to leave contracts open for whatever purpose."

Regan said SEIU will challenge the NUHW petitions. "We are not going to let these discredited, deposed members weaken UHW," he said, adding that the petition drive "is incredibly cynical and reckless in this economic climate."

But the wheels are now set in motion for a protracted fight over who will lead UHW’s 150,000 members, as well as the question of whether Rosselli’s highly democratic management style might be attractive to members of other unions.

"We’re getting calls from other SEIU members from other locals about joining NUHW," Rosselli said, citing Alameda County Medical Center, whose employees are part of the San Francisco–based SEIU Local 1021, one of many locals that have been reformulated in recent years by Stern, who then appoints its leaders.

Rosselli plans to hold a founding convention for NUHW in March, when members would vote on bylaws and a constitution, and elect their leaders, while Regan said SEIU will work to win the confidence of its members: "We have to show people that we’re on their side and we care about the work we have to do together."

Friday afternoon at the United Healthcare Workers headquarters, eight Oakland Police officers mediated a dispute between UHW members resisting the takeover by Service Employees International Union and SEIU representatives who showed up to take custody of the building. Both sides sought to convince the police to let their respective groups stay in the building.

Lover Joyce, a former UHW Executive Board member and medical assistant at Kaiser Walnut Creek, explained to reporters what the SEIU representatives had done around 11am. “They broke into the building, pushed our members” after using bolt-cutters to open the doors. Joyce and several other members had been sleeping at the office for a little over a week, so when SEIU leaders arrived, they called the Oakland Police Department. “We have the deed to the property!” he continued to assure the police and reporters. “It belongs to the Unity Healthcare Workers Corporation, not UHW or SEIU.”

Tara Gorewitz, a contract specialist for UHW at Walnut Creek Kaiser, later explained the history of why the building was legally given to the Unity Healthcare Workers Corporation and not to UHW or SEIU. She noted that Shirley Ware, the late Secretary-Treasurer of SEIU UHW- West Local 250, set up the deed in this manner so that the members, rather than the union, could retain rights to use the building in the case of a split.

SEIU seizes last holdout: UHW’s Oakland headquarters

The takeover of United Healthcare Workers by Service Employees International was completed today as SEIU finally took physical control of UHW’s Oakland headquarters and changed the locks following a final standoff that had to be mediated by Oakland Police officers who were called to the scene.

“We went to the office and we asked to be able to do the work we need to do,” David Regan, who SEIU appointed as a trustee overseeing UHW, told the Guardian. But they were turned away by UHW members still loyal to ousted president Sal Rosselli, who has formed a new rival union. “The police came and we sorted it all out.”

“We have been contacting tens of thousands of our members from all over the state over last few days and talking to them about the core work we should be doing,” Regan said, noting how important it is right now to present a united worker front to counteract deep proposed budget cuts by the state and its 58 counties.

SEIU took possession of UHW’s Los Angeles office shortly after the trusteeship was imposed on Tuesday afternoon, “and it’s a mess,” said SEIU spokesperson Michelle Ringuette. In their calls to members, she said that “a silent majority” are anxious to get past this union turf and aren’t likely to disaffiliate and join Rosselli’s new union.
But John Borsos, a spokeperson for the ousted UHW leaders, said members want a say in their union and “I believe thousands of current UHW members will seek to become part of this new union,” known at National Union of Healthcare Workers.

Both Ringuette and Regan downplayed the Oakland standoff, saying members are more important that offices. “But at the day, the reason the office is important is because it has tools we need to run the union effectively,” Regan said, citing membership data, payroll records, and files on ongoing contract negotiations as examples.

Ousted UHW leaders form the NUHW

There’s a new union in town, National Union of Healthcare Workers (NUHW), which was formed today by the United Healthcare Workers leadership team that was yesterday ousted by UHW’s parent union, Service Employees International Union. NUHW might as well stand for the New UHW.
SEIU has imposed a trusteeship on UHW, which involved suspending local bylaws, taking over UHW lists and contractual obligations, formally kicking out more than 70 elected UHW leaders, and appointing as trustees two SEIU executive vice presidents: David Regan and Eliseo Medina.
But UHW leaders continue to occupy the union’s Oakland headquarters, which they’ve used as the base of operations to launch the new union that they hope will be populated by many of UHW’s 150,000 members, who must vote to disaffiliate with SEIU to join the new union.
“As a healthcare workers union, NUHW is committed to continuing the tradition of a member-led, democratically controlled union,” ousted UHW head Sal Rosselli said in a prepared statement. “There are lot of things that we still have to figure out, but we know NUHW will be all about accountability to the members, democratic-decision-making, organizing the unorganized and winning improvements for healthcare workers and the patients and residents we serve.”
In a conference call with reporters, Regan and Medina blasted the Rosselli team for promoting the schism with SEIU, which had sought to transfer 65,000 long-term care workers from UHW to another SEIU local, something Rosselli says his members urged him to resist. “That battle ended yesterday,” Medina said, while Regan noted that, “It’s sad when a group of local officers lose their way.”
SEIU leaders hope to put the conflict behind them and move forward together to fight deep cuts being proposed in California’s budget, but it’s an open question how many UHW members are going to resist the change and follow Rosselli out the door, something that will become more clear in the coming weeks.

Union showdown

The Oakland-based United Healthcare Workers is bracing for an imminent takeover by its parent, Service Employees International Union, after defying an SEIU ultimatum to support the transfer of 65,000 UHW nursing home and homecare workers to a new local — without a member vote and with leadership appointed by SEIU.

The power struggle between SEIU President Andy Stern and UHW head Sal Rosselli and their respective boards, which has been escautf8g for the last year (see "A less perfect union," 4/9/08), came to a head Jan. 22 when SEIU’s International Executive Board approved findings of fiscal shenanigans and insubordination by UHW leaders and threatened to oust them and institute a trusteeship if six conditions were not met within five days.

To determine its response over the weekend, UHW organized meetings with about 5,000 of its members in San Francisco and four other cities, announcing the response during a raucous press conference at the Oakland headquarters the morning of Jan. 26, a day before the SEIU deadline.

"You ready everybody?" began Rosselli, flanked by a rainbow of 30 members and signs like "Hands off our UHW" and "Don’t Silence our Voices." The energized crowd of about 100 supporters answered with an enthusiastic, "Yeah!"

At that 11 a.m. rally, and in a teleconference an hour later with reporters from across the country, including from the Los Angeles Times and The Washington Post, Rosselli began by describing the UHW (which began with San Francisco General Hospital workers about 75 years ago) as perhaps the most effective, democratic, politicized, and oldest health care union in the country.

"We have an ideology that there’s no limit to empowering workers," Rosselli told reporters, announcing that UHW has unanimously approved a response letter to Stern that he characterized as "a compromise to avoid a civil war and get to the path of reconciliation."

But SEIU spokesperson Michelle Ringuette, while noting that her union’s leadership had not yet decided how to respond by Guardian press time, said the findings and conditions by special hearing officer Ray Marshall (who was the labor secretary under President Jimmy Carter) "was not a negotiation."

Marshall’s 105-page report concluded that "Leaders of the UHW did engage in financial malpractice and undermined democratic procedures when they transferred UHW funds to a nonprofit organization to be used in contests with the International Union." It set out conditions to avoid trusteeship that included supporting the transfer of long-term care workers, greater fiscal oversight by SEIU, purging the UHW database of names pilfered from SEIU, and publicizing the Marshall report to its members.

"Given that Sal Rosselli and his leadership team were just found guilty by Secretary Marshall of financial wrongdoing and trying to subvert the democratic processes of this union, there’s nothing surprising about this letter," Ringuette told the Guardian.

Yet an insistence on democratic processes was at the heart of the UHW stance against SEIU, which UHW leaders accuse of sacrificing the autonomy of locals in its drive for more national power, appointing leadership based on loyalty to Stern, colluding with large corporate employers, and turning a blind eye to corruption by Stern loyalists that was far more serious than any accusations against UHW.

UHW agreed to some of SEIU’s conditions, but insisted that its members be allowed to vote on the merger and elect their own leaders, and that SEIU work with UHW to craft a union that best represents member interests. In addition, it called for a mediated reconciliation process with SEIU that could culminate in a vote to create a single union representing all health care workers in California.

UHW members are fiercely loyal to that organization. To illustrate UHW’s effectiveness, Rosselli noted that SEIU locals representing nursing home workers recently negotiated contracts with wages $4 per hour less than UHW contracts and without UHW’s strong patient advocacy provisions. He also said that while UHW represents about 20 percent of statewide SEIU workers, the union filled 55 percent of the volunteer shifts in state and local elections.

"We’re a very democratic organization, and that’s what we believe is the key to our success," Rosselli said. "Workers want a strong voice in dealing with their employers, not just another boss in Washington, D.C."

All sides of the conflict express a desire to move forward. As Marshall wrote, "The UHW-SEIU conflict is hurting both organizations at a critical time in the development of the labor movement and progressive policies in the country." But it could be that the two sides have staked out intractable positions.

Rosselli was realistic about whether SEIU will accept the UHW counteroffer, telling reporters, "I don’t think it’s likely, but we hope that they will."

And what if they don’t?

Rosselli was careful to avoid threatening to lead an effort to disaffiliate UHW from SEIU if the trusteeship happens, noting that such advocacy is against SEIU rules and refusing to answer questions from reporters pushing the issue. But he made that possibility clear with statements such as "Our members have instructed us to resist this undemocratic transfer."

As to how UHW leaders will respond if and when SEIU takes over UHW and ousts them, Rosselli read from a prepared statement that said, "We would convene a meeting of our currently elected leaders and decide what to do next."

During the Oakland rally, Rosselli went a little further, reminding UHW members that they always retain the right to form a new union. The crowd applauded for 40 seconds and chanted, "Can we? Yes we can! Will we? Yes we will!"

As the conference concluded and attendees trickled away, homecare worker Tena Robinson grabbed a Guardian reporter and said she had a message to convey: "Andy Stern, we will never surrender!"

As she said it, Rosselli came over to hug her, as if embracing a family member. And then she told Rosselli that if he goes, "I’m going with you!"

SEIU pulls the trigger and ousts UHW leaders

Service Employees International Union President Andy Stern this afternoon executed his threat to take over the Oakland-based United Healthcare Workers and oust its defiant leadership team, formally placing UHW under a trusteeship.

“Today we bring an end to a sad chapter in the life [sic] a local union with great members, whose leadership lost their way, engaged in serious financial wrongdoing, refused to end their attempts to subvert the democratic processes of this union and failed to take action against a reported decertification effort,” Stern wrote in a prepared statement.

UHW head Sal Rosselli was careful to avoid advocating a decertification effort to divorce UHW for its SEIU parent during interviews with reporters yesterday (for more of this point, see my story in tomorrow’s Guardian), but that’s a real possibility now that Stern has ousted the leaders of their fiercely loyal union, precisely because they were doing the will of members in opposing an SEIU-ordered reorganization.

“Today’s action by Andy Stern imposing a trusteeship against the members of United Healthcare West has the effect of declaring martial law against those advocating for the right to vote and other democratic principles in their own union. UHW has rejected this imposition,” UHW wrote in a public statement.

Sources say they’re now a standoff between the rival union branches at UHW’s Oakland office. We’ll have more on this battle here tomorrow.

A high-stakes feud between United Healthcare Workers and its parent union, Service Employees International Union, reached a critical point today when SEIU’s International Executive Board approved a set of findings essentially accusing UHW of insubordination and financial irregularities and threatening to take over UHW if it doesn’t atone for its perceived sins within five days.

As the Guardian has reported, the conflict revolves around a power struggle between SEIU head Andy Stern, who has been seeking to consolidate power within the international, and UHW head Sal Rosselli (based out of the union’s Oakland office), who is seeking to preserve the autonomy of SEIU locals and affiliates, particularly his own.

UHW spokesperson Sadie Crabtree says the union’s executive board will be meeting soon to discuss how to respond to SEIU, which is threatening to take over UHW with a trusteeship within five days unless UHW agrees in writing to abide by an SEIU decision merging UHW’s long-term care workers into other SEIU locals, publicizes this decision to its members, purges its database of names allegedly pilfered from SEIU, and agrees to a fiscal audit by SEIU and to follow SEIU orders.

“The decision reaffirms that in SEIU, ‘justice’ means injustice for all those who disagree with Stern and his cronies,” UHW said in a press release, while SEIU put out a statement that, “SEIU leaders believe this is a moment of history to change this country, and we believe this decision offers an opportunity to join together everyone in SEIU to change America.”

It’s been a depressing decade for progressives. In fact, it seems our inability to fight the Bush administration and its misadventures in Iraq and elsewhere left us with the symptoms of a kind of collective Chronic Fatigue Syndrome: disillusioned, disappointed, and tired. That is, until Barack Obama’s election woke us up with a little thing called Hope™.

Now that we have all this energy, though, where should we direct it? How, on an individual level, can we support the Obama administration in making real change? Michelle Obama started to answer this question when she announced the Call to Service, asking Americans to devote time to neighborhood organizations and causes on Jan. 19 and beyond, via www.usaservice.org.

We’d like to add to the discussion by highlighting some local groups, causes, and nonprofits who could use year-round help.

ADVOCACY

Perhaps the best way to use your renewed political energy is putting it toward a cause you care about. For example, if you’re worried about how this year’s massive budget deficit might devastate healthcare in San Francisco, you might want to get involved with Coalition to Save Public Health (415-848-3611 ext. 3628, home.comcast.net/~mylon01/publichealth). Also check out nonprofits and grassroots groups working towards marriage equality, energy reform, or whatever pet issue you’re passionate about.

CITY GOVERNMENT

An even more direct way to be involved in local government is to volunteer inside City Hall, particularly with the San Francisco Board of Supervisors (1 Carlton B. Goodlett, SF. 415-554-5184, www.sfgov.org). Every supervisor has two aides, who in turn rely on donated labor to maintain the busy officials’ schedules and duties. To get involved, visit the Web site and fill out an application specifying your skills, availability, and preferred supervisors. Keep in mind four current supervisors once worked as staff or interns in these same offices, so this is a great way to get into politics while helping our government run more efficiently. It’s win-win.

BIKES


Though SF might seem like a bicycle-friendly city, we’ve still got a lot of work to do, from promoting the bike as primary transportation to representing bicycle interests in local government and city planning. If you’re a fellow velo-fanatic, give your time to the Bicycle Coalition (995 Market, SF. 415-431-BIKE, www.sfbike.org). Check the Web site to volunteer in the office, at Volunteer Nights, with bike valet parking, or with outreach.

PARKS

It’s easy to forget how important beautiful, open spaces are to a community until you don’t have them. But just imagine how different the Mission would be without Dolores Park, or the Lower Haight without Duboce. Support the maintenance, beautification, and continued improvement of these and other green spaces by volunteering with the Neighborhood Parks Council (451 Hayes, F. 415-621-3260, www.sfnpc.org). The Council welcomes everything from one-time feedback or participation in a scheduled work day to longer-term internships for youth 16-23 years old, and everything in between.

One of our favorite recent-ish developments on the Interwebs is the proliferation of Web sites connecting philanthropic types to specific causes — especially two SF-based organizations who work specifically with volunteers. Check out Chinatown-based Volunteermatch.org for a list of specific opportunities and a chance to upload your volunteer résumé — great for medium- to long-term volunteering — or former Best of the Bay winner One Brick (www.onebrick.org), which hosts an event calendar of upcoming volunteer events — great for one-time, short-term, and short-notice involvement.

Most important, we’d like to point out that community service, though incredibly important, is only one way to address our society’s ills. "It can be a Band-Aid approach to systemic problems," said Sup. Chris Daly. What we really need, he said, is "to demand more from elected leaders, for people to put themselves forward and take control of political institutions. There’s no greater service than keeping elected leaders accountable to the people they serve."

FREE MUSIC AND MOVIES

For a little extra routine effort, I’ve managed to make San Francisco’s library system my Netflix/GreenCine, rotating CD turntable, and bookstore, all rolled into one. And it’s all free.

If you’re a books-music-film whore like me, you find your home maxed out with piles of the stuff … and not enough extra cash to feed your habits. So I’ve decided to only buy my favorites and to borrow the rest. We San Franciscans have quite a library system at our fingertips. You just have to learn how to use it.

Almost everyone thinks of a library as a place for books. And that’s not wrong: you can read the latest fiction and nonfiction bestsellers, and I’ve checked out a slew of great mixology/cocktail recipe books when I want to try new drinks at home. I’ve hit up bios on my favorite musicians, or brought home stacks of travel books before a trip (they usually have the current year’s edition of at least one travel series for a given place, whether it be Fodor’s, Lonely Planet, or Frommer’s).

But there’s much more. For DVDs, I regularly check Rotten Tomatoes’ New Releases page (www.rottentomatoes.com/dvd/new_releases.php) for new DVD releases. Anything I want to see, I keep on a list and search www.sfpl.org for those titles every week. About 90 percent of my list eventually comes to the library, and most within a few weeks of the release date.

And such a range! I recently checked out the Oscar-nominated animated foreign film, Persepolis, the entire first season of Mad Men, tons of documentaries, classics (like a Cyd Charisse musical or Katherine Hepburn and Spencer Tracy’s catalog), even Baby Mama (sure, it sucked, but I can’t resist Tina Fey).

A music fanatic can find virtually every style, and even dig into the history of a genre. I’ve found CDs of jazz and blues greats, including Jelly Roll Morton, John Lee Hooker, Bessie Smith, Muddy Waters, kitschy lounge like Martin Denny and singer Julie London, and have satiated rap cravings with the latest Talib Kwali, Lyrics Born, Missy Elliott, T.I. or Kanye (I won’t tell if you won’t).

Warning: there can be a long "holds" list for popular new releases (e.g., Iron Man just came out and has about 175). When this happens, Just get in the queue — you can request as many as 15 items simultaneously online (you do have a library card, right?) You’ll get an e-mail when your item comes in and you can check the status of your list any time you log in. Keep DVDs a full seven days (three weeks for books and CDs) and return ’em to any branch you like.

I’ve deepened my music knowledge, read a broader range of books, and canceled GreenCine. Instead, I enjoy a steady flow of free shit coming my way each week. And if I get bored or the novelty of Baby Mama wears off, I return it and free up space in my mind (and on my shelf) for more. (Virginia Miller)

STYLE FOR A SONG

Shhh. The first rule about thrifting, to paraphrase mobsters and hardcore thrift-store shoppers, is don’t talk about thrifting — and that means the sites of your finest thrift scores. Diehard thrifters guard their favorite shops with jealous zeal: they know exactly what it’s like to wade through scores of stained T-shirts, dress-for-success suits, and plastic purses and come up with zilcherooni. They also know what it’s like to ascend to thrifter nirvana, an increasingly rarified plane where vintage Chanel party shoes and cool dead-stock Western wear are sold for a song.

Friendships have been trashed and shopping carts upended in the revelation of these much-cherished thrift stores, where the quest for that ’50s lamb’s fur jacket or ’80s acid-washed zipper jeans — whatever floats your low-budg boat — has come to a rapturous conclusion. It’s a war zone, shopping on the cheap, out there — and though word has it that the thrifting is excellent in Vallejo and Fresno, our battle begins at home. When the sample sales, designer runoff outlets, resale dives, and consignment boutiques dry up, here’s where you’ll find just what you weren’t looking for — but love, love, love all the same.

Community Thrift, 623 Valencia, SF. (415) 861-4910, www.communitythrift.bravehost.com. Come for the writer’s own giveaways (you can bequeath the funds raised to any number of local nonprofits), and leave with the rattan couches, deco bureaus, records, books and magazines, and an eccentric assortment of clothing and housewares. I’m still amazed at the array of intriguing junk that zips through this spot, but act fast or you’ll miss snagging that Victorian armoire.

Goodwill As-Is Store, 86 11th St., SF. (415) 575-2197, www.sfgoodwill.org. This is the archetype and endgamer of grab-and-tumble thrifting. We’re talking bins, people — bins of dirt cheap and often downright dirty garb that the massive Goodwill around the corner has designated unsuitable, for whatever reason. Dive into said bins, rolled out by your, ahem, gracious Goodwill hosts throughout the day, along with your competition: professional pickers for vintage shops, grabby vintage people, and ironclad bargain hunters. They may not sell items by the pound anymore — now its $2.25 for a piece of adult clothing, 50 cents to $1 for babies’ and children’s garb, $4 for leather jackets, etc. — but the sense of triumph you’ll feel when you discover a tattered 1930s Atonement-style poison-ivy green gown, or a Dr. Pimp-enstein rabbit-fur patchwork coat, or cheery 1950s tablecloths with negligible stainage, is indescribable.

Goodwill Industries, 3801 Third St., SF. (415) 641-4470, www.sfgoodwill.org Alas, not all Goodwills are created equal: some eke out nothing but stale mom jeans and stretched-out polo shirts. But others, like this Hunter’s Point Goodwill, abound with on-trend goodies. At least until all of you thrift-hungry hordes grab my junk first. Tucked into the corner of a little strip mall, this Goodwill has all those extremely fashionable hipster goods that have been leached from more populated thrift pastures or plucked by your favorite street-savvy designer to "repurpose" as their latest collection: buffalo check shirts, wolf-embellished T-shirts, Gunne Sax fairy-princess gowns, basketball jerseys, and ’80s-era, multicolored zany-print tops that Paper Rad would give their beards for.

Salvation Army, 1500 Valencia, SF. (415) 643-8040, www.salvationarmyusa.org. The OG of Mission District thrifting, this Salv has been the site of many an awesome discovery. Find out when the Army puts out the new goods. The Salvation soldiers may have cordoned off the "vintage" — read: higher priced — items in the store within the store, but there are still plenty of old books, men’s clothing, and at times hep housewares and Formica kitchen tables to be had: I adore the rainbow Mork and Mindy parka vest I scored in the boys’ department, as well as my mid-century-mod mustard-colored rocker.

Savers, 875 Main, Redwood City. (650) 364-5545, www.savers.com When the ladies of Hillsborough, Burlingame, and the surrounding ‘burbs shed their oldest, most elegant offerings, the pickings can’t be beat at this Savers. You’ll find everything from I. Magnin cashmere toppers, vintage Gucci tweed, and high-camp ’80s feather-and-leather sweaters to collectible dishware, antique ribbons, and kitsch-cute Holly Hobbie plaques. Strangest, oddly covetable missed-score: a psychiatrist’s couch.

Thrift Town, 2101 Mission, SF. (415) 861-1132, www.thrifttown.com. When all else fails, fall back on this department store-sized megalith. Back in the day, thrift-oldsters tell me, they’d dig out collectible paintings and ’50s-era bikes. Now you’ll have to grind deeply to land those finds, though they’re here: cute, mismatched, mid-century chairs; the occasional designer handbag; and ’60s knit suits. Hint: venture into less picked-over departments like bedding. (Kimberly Chun)

Low-cost groceries

Maybe you don’t qualify for food assistance programs or you just want to be a little thriftier — in which case the old adage that the early bird gets the metaphorical worm is apropos. When it comes to good food deals, timing can be everything. Here are a couple of handy tips for those of us who like to eat local, organic, and cheap. Go to Rainbow Grocery early and hit the farmers markets late. Rainbow has cheap and half-price bins in the bread and produce sections — but you wouldn’t know it if you’re a late-riser. Get there shortly after doors open at 9 a.m. for the best deals.

By the end of the day, many vendors at farmers markets are looking to unload produce rather than pack it up, so it’s possible to score great deals if you’re wandering around during the last half hour of the market. Then there’s the Grocery Outlet (2001 Fourth St., Berkeley and 2900 Broadway, Oakland, www.groceryoutlets.com), which puts Wal-Mart to shame. This is truly the home of low-cost living. Grocery Outlet began in 1946 in San Francisco when Jim Read purchased surplus government goods and started selling them. Now Grocery Outlets are the West Coast’s version of those dented-can stores that sell discounted food that wasn’t ready for prime-time, or perhaps spent a little too long in the limelight.

Be prepared to eat what you find — options range from name brands with trashed labels to foodstuffs you’ve never seen before — but there are often good deals on local breads and cheeses, and their wine section will deeply expand you Two-Buck Chuck cellar. Don’t be afraid of an occasional corked bottle that you can turn into salad dressing, and be sure to check the dates on anything perishable. The Grocery Outlet Web site (which has the pimpest intro music ever) lists locations and ways to sign up for coupons and download a brochure on how to feed your family for $3 a day. LIVE MUSIC FOR NOTHING — AND KICKS FOR FREE

Music should be free. Everyone who has downloaded music they haven’t been given or paid for obviously believes this, though we haven’t quite made it to that ideal world where all professional musicians are subsidized — and given health care — by the government or other entities. But live, Clive? Where do can you catch fresh, live sounds during a hard-hitting, heavy-hanging economic downturn? Intrepid, impecunious sonic seekers know that with a sharp eye and zero dough, great sounds can be found in the oddest crannies of the city. You just need to know where to look, then lend an ear. Here are a few reliables — occasional BART station busks and impromptu Ocean Beach shows aside.

Some of the best deals — read: free — on world-class performers happen seasonally: in addition to freebie fests like Hardly Strictly Bluegrass every October and the street fairs that accompanying in fair weather, there’s each summer’s Stern Grove Festival. Beat back the Sunset fog with a picnic of bread, cheese, and cheap vino, though you gotta move fast to claim primo viewing turf to eyeball acts like Bettye Lavette, Seun Kuti and Egypt 80, and Allen Toussaint. Look for the 2009 schedule to be posted at www.sterngrove.org May 1.

Another great spot to catch particularly local luminaries is the Yerba Buena Gardens Festival, which runs from May to October. Rupa and the April Fishes, Brass Menazeri, Marcus Shelby Trio, Bayonics, and Omar Sosa’s Afreecanos Quintet all took their turn in the sun during the Thursday lunchtime concerts. Find out who’s slated for ’09 in early spring at www.ybgf.org.

All year around, shopkeeps support sounds further off the beaten path — music fans already know about the free, albeit usually shorter, shows, DJ sets, and acoustic performances at aural emporiums like Amoeba Music (www.amoeba.com) and Aquarius Records (www.aquariusrecords.org). Many a mind has been blown by a free blast of new sonics from MIA or Boris amid the stacks at Amoeba, the big daddy in this field, while Aquarius in-stores define coziness: witness last year’s intimate acoustic hootenanny by Deerhoof’s Satomi and Tenniscoats’ Saya as Oneone. Less regular but still an excellent time if you happen upon one: Adobe Books Backroom Gallery art openings (adobebooksbackroomgallery.blogspot.com), where you can get a nice, low-key dose of the Mission District’s art and music scenes converging. Recent exhibition unveilings have been topped off by performances by the Oh Sees, Boner Ha-chachacha, and the Quails.

Still further afield, check into the free-for-all, quality curatorial efforts at the Rite Spot (www.ritespotcafe.net), where most shows at this dimly lit, atmospheric slice of old-school cabaret bohemia are as free as the breeze and as fun as the collection of napkin art in back: Axton Kincaid, Brandy Shearer, Kitten on the Keys, Toshio Hirano, and Yard Sale have popped up in the past. Also worth a looky-loo are Thee Parkside‘s (www.theeparkside.com) free Twang Sunday and Happy Hour Shows: a rad time to check out bands you’ve never heard of but nonetheless pique your curiosity: Hukaholix, hell’s yeah! And don’t forget: every cover effort sounds better with a pint — all the better to check into the cover bands at Johnny Foley’s (www.johnnyfoleys.com), groove artists at Beckett’s Irish Pub in Berkeley (www.beckettsirishpub.com), and piano man Rod Dibble and his rousing sing-alongs at the Alley in Oakland (510-444-8505). THE CHEAPEST WAY TO GET AROUND TOWN

Our complex world often defies simple solutions. But there is one easy way to save money, get healthy, become more self-sufficient, free up public resources, and reduce your contribution to air pollution and global warming: get around town on a bicycle.

It’s no coincidence that the number of cyclists on San Francisco streets has increased dramatically over the last few years, a period of volatile gasoline prices, heightened awareness of climate change, poor Muni performance, and economic stagnation.

On Bike to Work Day last year, traffic counts during the morning commute tallied more bicycles than cars on Market Street for the first time. Surveys commissioned by the San Francisco Bicycle Coalition show that the number of regular bike commuters has more than doubled in recent years. And that increase came even as a court injunction barred new bike projects in the city (see "Stationary biking," 5/16/07), a ban that likely will be lifted later this year, triggering key improvements in the city’s bicycle network that will greatly improve safety.

Still not convinced? Then do the math.

Drive a car and you’ll probably spend a few hundred dollars every month on insurance, gas, tolls, parking, and fines, and that’s even if you already own your car outright. If you ride the bus, you’ll pay $45 per month for a Fast Pass while government will pay millions more to subsidize the difference. Riding a bike is basically free.

Free? Surely there are costs associated with bicycling, right? Yeah, sure, occasionally. But in a bike-friendly city like San Francisco, there are all kinds of opportunities to keep those costs very low, certainly lower than any other transportation alternative except walking (which is also a fine option for short trips).

There are lots of inexpensive used bicycles out there. I bought three of my four bicycles at the Bike Hut at Pier 40 (www.thebikehut.com) for an average of $100 each and they’ve worked great for several years (my fourth bike, a suspension mountain bike, I also bought used for a few hundred bucks).

Local shops that sell used bikes include Fresh Air Bicycles, (1943 Divisidero, www.fabsf.com) Refried Cycles (3804 17th St., www.refriedcycles,com/bicycles.htm), Karim Cycle (2800 Telegraph., Berkeley, www.teamkarim.com/bikes/used/) and Re-Cycles Bicycles (3120 Sacramento, Berkeley, www.recyclesbicycles.com). Blazing Saddles (1095 Columbus, www.blazingsaddles.com) sells used rental bikes for reasonable prices. Craigslist always has listings for dozens of used bikes of all styles and prices. And these days, you can even buy a new bike for a few hundred bucks. Sure, they’re often made in China with cheap parts, but they’ll work just fine.

Bikes are simple yet effective machines with a limited number of moving parts, so it’s easy to learn to fix them yourself and cut out even the minimal maintenance costs associated with cycling. I spent $100 for two four-hour classes at Freewheel Bike Shop (1920 Hayes and 914 Valencia, www.thefreewheel.com) that taught me everything I need to know about bike maintenance and includes a six-month membership that lets me use its facilities, tools, and the expertise of its mechanics. My bikes are all running smoother than ever on new ball bearings that cost me two bucks per wheel, but they were plenty functional even before.

There are also ways to get bike skills for free. Sports Basement (www.sportsbasement.com) offers free bicycle maintenance classes at both its San Francisco locations the first Tuesday of every month from 6:30-7:30 p.m. Or you can turn to the Internet, where YouTube has a variety of bike repair videos and Web sites such as www.howtofixbikes.com can lead you through repairs.

The nonprofit The Bike Kitchen (1256 Mission, www.thebikekitchen.org) on Mission Street offers great deals to people who spend $40 per year for a membership. Volunteer your time through the Earn-a-Bike program and they’ll give you the frame, parts, and skills to build your own bike for free.

But even in these hard economic times, there is one purchase I wouldn’t skimp on: spend the $30 — $45 for a good U-lock, preferably with a cable for securing the wheels. Then you’re all set, ready to sell your car, ditch the bus, and learn how easy, cheap, fast, efficient, and fun it is to bicycle in this 49-square-mile city. (Steven T. Jones)

LOW-COST HEALTH CARE

When money’s tight, healthcare tends to be one of the first costs we cut. But that can be a bad idea, because skimping on preventive care and treatment for minor issues can lead to much more expensive and serious (and painful) health issues later. Here is our guide to Bay Area institutions, programs, and clinics that serve the under- and uninsured.

One of our favorite places is the Women’s Community Clinic (2166 Hayes, 415-379-7800, www.womenscommunityclinic.org), a women-operated provider open to anyone female, female-identified, or female-bodied transgender. This awesome 10-year-old clinic offers sexual and reproductive health services — from Pap smears and PMS treatment to menopause and infertility support — to any SF, San Mateo, Alameda, or Marin County resident, and all on a generous sliding scale based on income and insurance (or lack thereof). Call for an appointment, or drop in on Friday mornings (but show up at 9:30 a.m. because spots fill up fast).

A broader option (in terms of both gender and service) is Mission Neighborhood Center (main clinic at 240 Shotwell. 415-552-3870, www.mnhc.org, see Web site for specialty clinics). This one-stop health shop provides primary, HIV/AIDS, preventive, podiatry, women’s, children’s, and homeless care to all, though its primary focus is on the Latino/Hispanic Spanish-speaking community. Insurance and patient payment is accepted, including a sliding scale for the uninsured (no one is denied based on inability to pay). This clinic is also a designated Medical Home (or primary care facility) for those involved in the Healthy San Francisco program.

Contrary to popular belief, Healthy San Francisco (www.healthysanfrancisco.org) is not insurance. Rather, it’s a network of hospitals and clinics that provide free or nearly free healthcare to uninsured SF residents who earn at or below 300 percent of the federal poverty level (which, at about $2,600 per month, includes many of us). Participants choose a Medical Home, which serves as a first point-of-contact. The good news? HSF is blind to immigration status, employment status, and preexisting medical conditions. The catch? The program’s so new and there are so many eligible residents that the application process is backlogged — you may have a long wait before you reap the rewards. Plus, HSF only applies within San Francisco.

Some might consider mental health less important than that of the corporeal body, but anyone who’s suffered from depression, addiction, or PTSD knows otherwise. Problem is, psychotherapy tends to be expensive — and therefore considered superfluous. Not so at Golden Gate Integral Counseling Center (507 Polk. 415-561-0230, www.goldengatecounseling.org), where individuals, couples, families, and groups can get long- and short-term counseling for issues from stress and relationships to gender identity, all billed on a sliding scale.

Other good options

American College of Traditional Chinese Medicine (450 Connecticut, 415-282-9603, actcm.edu). This well-regarded school provides a range of treatments, including acupuncture, cupping, tui ma/shiatsu massage, and herbal therapy, at its on-site clinics — all priced according to a sliding scale and with discounts for students and seniors. The college also sends interns to specialty clinics around the Bay, including the Women’s Community Clinic, Haight Ashbury Free Medical Clinic, and St. James Infirmary.

St. James Infirmary (1372 Mission. 415-554-8494, www.stjamesinfirmary.org). Created for sex-workers and their partners, this Mission District clinic offers a range of services from primary care to massage and self-defense classes, for free. Bad ass.

Free Print Shop (www.freeprintshop.org): This fantabulous Webs site has charts showing access to free healthcare across the city, as well as free food, shelter, and help with neighborhood problems. If we haven’t listed ’em, Free Print Shop has. Tell a friend.

Native American Health Center (160 Capp, 415-621-8051, www.nativehealth.org). Though geared towards Native Americans, this multifaceted clinic (dental! an Oakland locale, and an Alameda satellite!) turns no one away. Services are offered to the under-insured on a sliding scale as well as to those with insurance.

SF Free Clinic (4900 California, 415-750-9894, www.sffc.org). Those without any health insurance can get vaccinations, diabetes care, family planning assistance, STD diagnosis and treatment, well child care, and monitoring of acute and chronic medical problems.

Haight Ashbury Free Clinics (558 Clayton. 415-746-1950, www.hafci.org): Though available to all, these clinics are geared towards the uninsured, underinsured "working poor," the homeless, youth, and those with substance abuse and/or mental health issues. We love this organization not only for its day-to-day service, but for its low-income residential substance abuse recovery programs and its creation of RockMed, which provides free medical care at concerts and events. THE BEST HOMELESS SHELTERS

There’s no reason to be ashamed to stay in the city’s homeless shelters — but proceed with awareness. Although most shelters take safety precautions and men and women sleep in separate areas, they’re high-traffic places that house a true cross-section of the city’s population.

The city shelters won’t take you if you just show up — you have to make a reservation. In any case, a reservation center should be your first stop anyway because they’ll likely have other services available for you. If you’re a first-timer, they’ll want to enter you into the system and take your photograph. (You can turn down the photo-op.) Reservations can be made for up to seven days, after which you’ll need to connect with a case manager to reserve a more permanent 30- or 60-day bed.

The best time to show up is first thing in the morning when beds are opening up, or late at night when beds have opened up because of no-show reservations. First thing in the morning means break of dawn — people often start lining up between 4 a.m. and 6 a.m. for the few open beds. Many people are turned away throughout the day, although your chances are better if you’re a woman.

You can reserve a bed at one of several reservation stations: 150 Otis, Mission Neighborhood Resource Center (165 Capp St.), Tenderloin Resource Center (187 Golden Gate), Glide (330 Ellis), United Council (2111 Jennings), and the shelters at MSC South (525 Fifth St.) and Hospitality House (146 Leavenworth). If it’s late at night, they may have a van available to give you a ride to the shelter. Otherwise, bus tokens are sometimes available if you ask for one — especially if you’re staying at Providence shelter in the Bayview-Hunters Point District.

They’ll ask if you have a shelter preference — they’re all a little different and come with good and bad recommendations depending on whom you talk to. By all accounts, Hospitality House is one of the best — it’s small, clean, and well run. But it’s for men only, as are the Dolores Street Community Services shelters (1050 S. Van Ness and 1200 Florida), which primarily cater to Spanish-speaking clients.

Women can try Oshun (211 13th St.) and A Woman’s Place (1049 Howard) if they want a men-free space. If kids are in tow, Compass Family Services will set you up with shelter and put you on a waiting list for housing. (A recent crush of families means a waiting list for shelters also exists.) People between 18 and 24 can go to Lark Inn (869 Ellis). The Asian Woman’s Shelter specializes in services for Asian-speaking women and domestic violence victims (call the crisis line 877-751-0880). IMPRESS A DATE WITH DINNER UNDER $50

You’ve got a date this weekend, which you’re feeling pretty good about, but only $50 to spend, which feels … not so good. Where should you go?

You’ll appear in-the-know at the underrated Sheba Piano Lounge (1419 Fillmore, www.shebalounge.com) on lower Fillmore Street, right in the middle of the burgeoning jazz revival district. Sheba was around long before Yoshi’s, offering live jazz (usually piano, sometimes a vocalist) and some of the best Ethiopian food in the city in a refined, relaxed lounge setting. Sure, they’ve got Americanized dishes, but skip those for the traditional Ethiopian menu. Sample multiple items by ordering the vegetarian platter ($13) or ask for a mixed meat platter, which is not on the menu ($16 last time I ordered it). One platter is more than enough for two, and you can still afford a couple of cocktails, glasses of wine or beer, or even some Ethiopian honey wine (all well under $10). Like any authentic Ethiopian place I’ve eaten in, the staff operates on Africa time, so be prepared to linger and relax.

It’s a little hipster-ish with slick light fixtures, a narrow dining room/bar, and the increasingly common "communal table" up front, but the Mission District’s Bar Bambino (2931 16th St., www.barbambino.com) offers an Italian enoteca experience that says "I’ve got some sophistication, but I like to keep it casual." Reserve ahead for tables because there aren’t many, or come early and sit at the bar or in the enclosed back patio and enjoy an impressive selection of Italian wines by the glass ($8–$12.50). For added savings with a touch of glam, don’t forget their free sparkling water on tap. It’s another small plates/antipasti-style menu, so share a pasta ($10.50–$15.50), panini ($11.50–$12.50), and some of their great house-cured salumi or artisan cheese. Bar Bambino was just named one of the best wine bars in the country by Bon Apetit, but don’t let that deter you from one of the city’s real gems.

Nothing says romance (of the first date kind) like a classic French bistro, especially one with a charming (heated) back patio. Bistro Aix (3340 Steiner, www.bistroaix.com) is one of those rare places in the Marina District where you can skip the pretension and go for old school French comfort food (think duck confit, top sirloin steak and frites, and a goat cheese salad — although the menu does stray a little outside the French zone with some pasta and "cracker crust pizza." Bistro Aix has been around for years, offering one of the cheapest (and latest — most end by 6 or 7 p.m.) French prix fixe menus in town (Sunday through Thursday, 6–8 p.m.) at $18 for two courses. This pushes it to $40 for two, but still makes it possible to add a glass of wine, which is reasonably priced on the lower end of their Euro-focused wine list ($6.25–$15 a glass).

FREE YOGA

You may be broke, but you can still stay limber. San Francisco is home to scores of studios and karmically-blessed souls looking to do a good turn by making yoga affordable for everyone.

One of the more prolific teachers and donation-based yoga enthusiasts is Tony Eason, who trained in the Iyengar tradition. His classes, as well as links to other donation-based teachers, can be found at ynottony.com. Another great teacher in the Anusara tradition is Skeeter Barker, who teaches classes for all levels Mondays and Wednesdays from 7:45 to 9:15 p.m. at Yoga Kula, 3030a 16th St. (recommended $8–$10 donation).

Sports Basement also hosts free classes every Sunday at three stores: Bryant Street from 1 to 2 p.m., the Presidio from 11a.m. to noon, and Walnut Creek 11 a.m. to noon. Bring your own mat.

HOW TO KEEP YOUR APARTMENT

So the building you live in was foreclosed. Or you missed a few rent payments. Suddenly there’s a three-day eviction notice in your mailbox. What now?

Don’t panic. That’s the advice from Ted Gullicksen, executive director of the San Francisco Tenants Union. Tenants have rights, and evictions can take a long time. And while you may have to deal with some complications and legal issues, you don’t need to pack your bags yet.

Instead, pick up the phone and call the Tenants Union (282-6622, www.sftu.org) or get some professional advice from a lawyer.

The three-day notice doesn’t mean you have to be out in three days. "But it does mean you will have to respond to and communicate with the landlord/lady within that time," Gullicksen told us.

It’s also important to keep paying your rent, Gullicksen warned, unless you can’t pay the full amount and have little hope of doing so any time soon.

"Nonpayment of rent is the easiest way for a landlord to evict a tenant," Gullicksen explained. "Don’t make life easier for the landlady who was perhaps trying to use the fact that your relatives have been staying with you for a month as grounds to evict you so she can convert your apartment into a pricey condominium."

There are, however, caveats to Gullicksen’s "always pay the rent" rule: if you don’t have the money or you don’t have all the money.

"Say you owe $1,000 but only have $750 when you get the eviction notice," Gullicksen explained. "In that case, you may want to not pay your landlord $750, in case he sits on it but still continues on with the eviction. Instead, you might want to put the money to finding another place or hiring an attorney."

A good lawyer can often delay an eviction — even if it’s over nonpayment or rent — and give you time to work out a deal. Many landlords, when faced with the prospect of a long legal fight, will come to the table. Gullicksen noted that the vast majority of eviction cases end in a settlement. "We encourage all tenants to fight evictions," he said. The Tenants Union can refer you to qualified tenant lawyers.

These days some tenants who live in buildings that have been foreclosed on are getting eviction notices. But in San Francisco, city officials are quick to point out, foreclosure is not a legal ground for eviction.

Another useful tip: if your landlord is cutting back on the services you get — whether it’s a loss of laundry facilities, parking, or storage space, or the owner has failed to do repairs or is preventing you from preventing you from "the quiet enjoyment of your apartment" — you may be able to get a rent reduction. With the passage of Proposition M in November 2008 tenants who have been subjected to harassment by their landlords are also eligible for rent reductions. That involves a petition to the San Francisco Rent Stabilization and Arbitration Board (www.sfgov.org/site/rentboard_index.asp).

Gullicksen also recommends that people who have lost their jobs check out the Eviction Defense Collaborative (www.evictiondefense.org).

"They are mostly limited to helping people who have temporary shortfalls," Gullicksen cautioned. But if you’ve lost your job and are about to start a new one and are a month short, they can help. (Sarah Phelan)

OUT OF WORK? HERE’S STEP ONE

How do you get your unemployment check?

"Just apply for it."

That’s the advice of California’s Employment Development Department spokesperson Patrick Joyce.

You may think you aren’t eligible because you may have been fired or were only working part-time, but it’s still worth a try. "Sometimes people are ineligible, but sometimes they’re not," Joyce said, explaining that a lot of factors come into play, including your work history and how much you were making during the year before you became unemployed.

"So, simply apply for it — if you don’t qualify we’ll tell you," he said. "And if you think you are eligible and we don’t, you can appeal to the Unemployment Insurance Appeals Board."

Don’t wait, either. "No one gets unemployment benefits insurance payments for the first week they are unemployed," Joyce explained, referring to the one-week waiting period the EDD imposes before qualified applicants can start collecting. "So you should apply immediately."

Folks can apply by filling out the unemployment insurance benefits form online or over the phone. But the phone number is frequently busy, so online is the best bet.

Sentenced to rape

It’s been 60 years since the United Nations General Assembly issued the Universal Declaration of Human Rights, affirming the inherent dignity and inalienable rights of all people. Yet prisoners are often denied the most basic protections of the law. Rape is still a brutal reality in prison, a problem that disproportionately affects LGBT inmates.

In 2003, Congress unanimously passed the Prison Rape Elimination Act (PREA), creating federal mandates to fight sexual assault in prisons. But its implementation has been slow. This year, the Bureau of Justice Statistics conducted the first national survey of violence in the corrections system. It found sexual orientation to be the single greatest determinant for sexual abuse in prisons — 18.5 percent of homosexual inmates reported sexual assault, compared to 2.7 percent of heterosexual prisoners. Though PREA aims to reduce these figures, prisoners and their advocates have been waiting on its official guidelines, which are set for release in 2009.

In an attempt to address California’s challenges in protecting LGBT inmates, California Sen. Gloria Romero held an informational meeting Dec. 11 in San Francisco, bringing together former LGBT prisoners, advocates, experts, and representatives from the California Department of Corrections and Rehabilitation (CDCR).

"Nobody has it easy in prisons, and LGBT persons in particular experience unique kinds of harassment, discrimination, and violence when incarcerated," said Masen Davis, executive director of the Transgender Law Center.

Inherent flaws in our social institutions result in a disproportionate number of LGBT prisoners. Discrimination in employment, housing, and healthcare often force members of the LGBT community, particularly transgender individuals, to turn to the street economy to support themselves. A survey by the Transgender Law Center found that fewer than half of transgender adults held a full-time job, and one in five have experienced homelessness since becoming transgender (see "Transjobless," 3/15/06). These factors greatly increase the instance of criminal activity in the LGBT community. The Center for Health Justice reports that more than two-thirds of male-to-female transgender San Franciscans have been incarcerated; in six other major urban areas, one in four gay men had been incarcerated.

Once LGBT individuals enter the California prison system, says Linda McFarlane, deputy executive director of Just Detention International, they are 15 times more likely to experience sexual assault than the general population. In addition, she said, prison staff more often fail to protect these inmates than others, and are more likely to believe that assaults are consensual.

"There seems to be a belief among some corrections officers that rape is unavoidable in prison," McFarlane said. "It’s been asked more than once in training sessions that if transgender inmates are at such risk, why are they still allowed to be transgender within the prison environment?"

Alex Lee, a co-director of the Transgender, Gender Variant, and Intersex Justice Project, read a statement from Bella Christina Borrell, a 56-year-old transgender inmate: "Female transgender prisoners are the ultimate target for sexual assault and rape. In this hyper-masculine world, inmates who project feminine characteristics attract unwanted attention and exploitation by others seeking to build up their masculinity by dominating and controlling women."

Of course, there are policies in place that should protect inmates from each other. PREA stipulates that sexual assault during incarceration can constitute a violation of the Eighth Amendment to the US Constitution, and mandates that facilities employ a zero-tolerance policy toward abuse. However, like many things in life, the theory and practice have little in common.

"We’ve heard multiple times about officers openly expressing a belief that gay and transgender inmates cannot be raped, that they deserve to be raped due to their mere presence in the environment, or that if they are raped it’s simply not a concern," McFarlane said.

Joe Sullivan of the California Department of Corrections and Rehabilitation said policy dictates that gay or transgender status alone does not warrant specific housing arrangements. He said the department prefers to integrate inmates in a setting that most closely resembles what they will be returning to after being paroled. When they arrive in prison, inmates are evaluated using a system called Compass, which is a set of guidelines to determine each person’s specific needs. During this time, inmates are able to state whether they feel they need special arrangements.

"It’s a framework that is followed by the staff at institutions," Sullivan said. "Some of the things I heard today suggest that how the framework is interpreted is one of the issues we’ll have to go look into and do some further training on."

It has been suggested that the previously used designations Category B and SOR (sexual orientation), which include guidelines for "effeminately homosexual" men, might aid CDCR in their classification process. However, as Sullivan stated, the prison system’s evaluation procedure largely ignores these special circumstances.

"The classification process is gender-neutral," Sullivan said. "We try to address the individual’s specific needs, as opposed to having a policy for a group or a class of people. We really don’t distinguish between transgender and non-transgender inmates."

While this policy is certainly egalitarian, it ignores the extreme vulnerability of LGBT inmates, something many prisoners don’t realize until after they’ve been victimized. Then, all too often, they are placed in isolation cells usually reserved as punitive measures.

"If they have been a victim of a sexual assault, they can be and will be single-celled, at least for the period of time that we go through investigating the allegations," Sullivan said. "We try to do it in an expedient manner, so that the victim is not the one sitting in administrative segregation."

The panelists all agreed that eliminating sexual violence against the LGBT community requires some of our most precious resources: time, energy, and money. In the past, the general rule has been to increase spending for prisons while simultaneously reducing funds for social programs like housing, employment, and health care, which all have a lot do to with the amount of crime in the first place.

Advocates recommend that an effective classification system must be implemented. First, corrections officials have to acknowledge that factors like an inmate’s sexual orientation or transgender status put them at an exceptionally high risk for violence. Second, steps must be taken to reduce the instances of harassment, abuse, and sexual assault suffered by inmates. Female transgender inmates must be issued sports bras and should be allowed to shower separately from the general population to curb humiliation and predation. If an assault occurs, victims should not be placed in punitive custody, the complaint must remain confidential, and assailants cannot be allowed the opportunity to retaliate. Finally, corrections officers should have to participate in an extensive training program to help them deal with these factors.

Bambi Salcedo, a transgender ex-convict who now works with transgender youth at Children’s Hospital Los Angeles put it simply: "We have to realize that homosexual and transgender inmates must be treated with dignity in the correctional system."

7.5 better ways to balance the budget

OPINION In Mayor Gavin Newsom’s seven-and-a-half-hour YouTube series on the state of our city, he spends barely 30 seconds addressing the budget deficit.

Newsom’s mid-year budget cut plan is completely out of touch with the fundamental priorities of our city. At a time when residents are feeling the impact of the recession in their daily lives, the mayor’s plan guts our public health safety net by slashing programs that serve seniors on fixed incomes and by reducing frontline healthcare workers.

What’s more, the mayor’s mid year cuts leave untouched his bloated senior staff and protects management-heavy departments around City Hall.

So, in response to the effort to balance the budget by slashing tens of millions in health services for the city’s neediest, a coalition of health workers, health providers, and patients are putting forward alternative ways to address the city’s budget problem that are worth our time and thought.

Among the ideas offered by the Coalition to Save Public Health are the following:

1. Start at the top, not at the bottom. Since the mayor first took office, the number of highly paid managers has skyrocketed while the number of employees providing basic city services has stagnated. It’s time to tighten our belt at the management level and eliminate all but the most essential positions that pay more than $100,000 per year.

2. Practice what you preach. In November 2007, the mayor announced a non-essential hiring freeze to deal with the budget crunch. Newsom then promptly spent hundreds of thousands of dollars hiring new senior staff including highly paid and duplicative special assistants for climate control initiatives, "neighborhood empowerment," and a new greening czar. All new staff hired since November 2007 who are paid more than $100,000 should be cut.

3. Cut duplicative programs. The city spends more than $10 million per year on small business outreach and economic development. The Mayor’s Small Business Assistance Center duplicates those services and costs nearly $800,000 every year.

4. Listen to the voters — cut the Community Justice Court. Proposition L was rejected by more than 57 percent of the San Francisco electorate. It’s time to listen to the voters and preserve revenue by cutting current-year funding for the CJC.

5. Save on spin, spend on substance. A recent controller’s report found that the city spent more than $10 million in salaries for public relations and public information staff, including funding for seven people in the Mayor’s Office of Communications last year. The mayor should cut all unnecessary PR staff and reduce his spin operation to two people.

6. Cut the fat, not the bone. Both police and fire unions are due for 7 percent pay increases. As the city cuts salaries or lays off staff across the board, the mayor should work with the board to reopen fire and police contracts.

7. Eliminate unnecessary drivers. For years, the Fire Department’s battalion chiefs have relied on "chief’s aides" to chauffer them around the city. The estimated cost for these positions is more than $2 million.

7.5 Cut in half the city’s contribution to the opera and symphony. In the current year, the city is contributing close to $4 million in General Fund revenue to the operation of the opera, symphony, and ballet. We can’t afford to subsidize organizations with enormous endowments while we slash services for people in need.

GGRA members accused of hypocrisy

News that GGRA has decided to file an en banc appeal of the Ninth Circuit’s ruling upholding the City’s Healthcare Security Ordinance got supporters of the City’s ordinance expressing dismay and puzzlement.

They also declared themselves troubled by what they call the apparent hypocrisy of GGRA members who express their support for the ordinance in surcharge notices.

Tim Paulson, San Francisco Labor Council executive director, believes that the City’s healthcare ordinance creates a level playing field for employers.

“It gives credit to employers who already offer healthcare to their employees and also allows other employers to comply without disrupting ERISA plans,” Paulson said. “The Healthcare Ordinance is sound business policy as well as a win for San Franciscans.”

Calling the Ninth Circuit’s September 30 decision to uphold the City’s ordinance, “a huge win for hard-working men and women in San Francisco who are currently without access to healthcare,” Paulson said, “We need more healthcare in San Francisco, not less.”

Paulsen said he was “particularly troubled by the apparent hypocrisy of GGRA member restaurants for expressing public support and admiration for a program that provides health and well-being to thousands of restaurant workers, while their GGRA membership dues pay the legal fees to dismantle it.”

Paulson was referring to the fact that some GGRA member restaurants have issued surcharge notices that contain comments that appear to be supportive of SF’s healthcare program, while GGRA seeks to overturn the ordinance.

IGGRA members Catch, Pomodoro, AsiaSF, Bar Bambino and Luna Park have issued notices in which they express support for the ordinance and explain that they are adding a surcharge to each check to cover these new healthcare related costs. The notices do not mention GGRA’s lawsuit.

Will SF’s healthcare ordinance go to Supreme Court?

The Ninth Circuit’s decision to uphold San Francisco’s Health Care Security Ordinance got everyone wondering if the Golden Gate Restaurant Association will take the matter all the way to the Supreme Court.

GGRA’s executive director Kevin Westly told me they might, or they might ask the Ninth Circuit to do an en banque review, instead, which involves all eleven Ninth Circuit judges.

“Healthy San Francisco is a good program and employer spending mandates are a separate issue,” Westly said, repeating a position that Mayor Gavin Newsom used to share, back when Sup. Tom Ammiano, who authored this trailbreaking legislation, was trying to explain that it’s not fiscally possible to provide uninsured residents with free access to the City’s health clinics without the employer mandate , since the mandate generates the funding for the free access program.

Newsom eventually climbed on board, ( “kicking and screaming” as Ammiano recently recalled), but GGRA continues to hold that the mandate is a major fiscal and administrative burden that employers shouldn’t bear. GGRA makes that argument based on their interpretation of Congress’s intent in 1974, when it passed ERISA.

9th Circuit OKs City’s Healthcare Access Plan

The U.S. Court of Appeals for the Ninth Circuit has decided in favor of the city’s healthcare access ordinance.
The Golden Gate Restaurant Association, which was the group that filed suit against San Francisco over the City’s trailblazing plan, could still appeal to the U.S. Supreme Court, a move that would cost beaucoup bucks all round.
Here’s my favorite part of this recent ruling, written in delicious legalese:

“There may be better ways to provide healthcare that to require employers in the City of San Francisco to foot the bill. But our task is a narrow one and it is beyond our province to evaluate the wisdon ofthe Ordinance before us. We are asked only to decide whether Section 514 (a) of ERISA preempts the employer spending requirement of the Ordinance. We hold that it does not. The spending requirements do not establish an ERISA plan; nor do they have an impermissible connection with employers’ ERISA plan,or make an impermissible reference to such plan. We therefore reverse the judgment of the district court and remand with instructions to enter summary judgement in favor of the City and Intervenors.”

SEIU – Why it matters

September 26 and 27 should be eventful days at the San Mateo County Event Center. A place there called Fiesta Hall will probably be very loud, but not be very festive. Thousands of United Healthcare Workers (UHW) union members plan to protest hearings on whether to remove their leadership for allegedly misappropriating dues money.

People not involved with or knowledgeable of union activity might not think this is a big deal, but trust me – it is.

As I’ve reported here, here, and here – UHW’s leader Sal Rosselli has been feuding with Andy Stern, head of UHW’s parent union, the Service Employees International Union, over what he calls Stern’s undemocratic regime. If Barack Obama is elected, he will definitely owe Andy Stern and SEIU a major debt. SEIU is putting almost $90 million into Obama’s White House run. And if Stern is as autocratic as Rosselli and his supporters claim, the future of a Democratic majority in Washington might not be as progressive as many liberals hope – especially when it comes to lifting workers out of poverty by organizing them into unions like SEIU.

Rosselli says Stern suppresses dissent, sells out his members, and makes secret deals with corporate America. That kind of behavior in one of the Democrats’ biggest benefactors won’t help Obama bring the kind of “change we deserve.” On the other hand, if unions like UHW illegally divert millions of dollars of their members’ money into shadowy slush funds – as Stern and SEIU have charged — that won’t exactly help rejuvenate the left either.

Bottom line, even though a small percentage of workers are unionized these days, what goes on in San Mateo this weekend could have an big effect on the country’s political landscape. Stay tuned.

PS: UHW sources called me this morning and said Stern had barred observers from the federal labor department from attending the hearing. They pointed to a letter, dated yesterday, from labor department officials that appeared to confirm this. However, I just got off the phone with the person at the department to whom the letter was sent. He said SEIU has changed its mind and decided to allow the officials in if they seek access.

UPDATE: An SEIU spokesperson called this morning and insisted that the international union never actively barred Department of Labor (DOL) officials from the hearings. According to SEIU’s Michelle Ringuette, DOL made an inquiry directly to Ray Marshall, who is conducting the hearings. As soon as SEIU officials found out DOL wanted to attend, Ringuette went on, they agreed to let them in. “DOL is welcome,” she told me.

Also, I made a goof in my “PS” section above. The Department of Labor official I spoke with yesterday, Dennis Eckert at the Office of Labor Management Standards, actually sent the letter to which I linked. (I wrote that he was the addressee. Apologies.)

I realize when reading them that we homos have so few descriptive windows onto other geigh peoples’ lives: we mostly meet in (mostly, unfortunately) spaces of assimilation, bars and clubs and online and such, where the curious quotidian details of our existence get no airing … perhaps this is why the obituaries have been so popular? Because they’re actually about real gay homos’ real lives, not just those who are promoting something? Of course, the thing with the obituaries is tied up with everyone’s shared health issue fears (even the BAR ran a triumphant “No Obituaries!” headline when effective AIDS meds started to take hold), but still … it’s nice to find out more about people before they’re dead!

Just as the US presidential election hits the home stretch, internal strife at one of the country’s largest labor unions appears to be diverting its focus from electing Barack Obama.

The Service Employees International Union (SEIU) and its 2 million members helped Obama defeat Hillary Clinton in the Democratic primary. Its ground operation and bulging political war chest are crucial to Democratic Party hopes in November, both in the presidential election and congressional races. But a recent corruption scandal and an ongoing internal dispute that threatens to blow up in the coming weeks could undermine the union’s political influence at the worst possible time.

"If SEIU didn’t have to deal with this distraction, it would be able to do more to influence the election," Dan Clawson, a labor scholar and professor of sociology at the University of Massachusetts, Amherst, told the Guardian. "California [where nearly all of SEIU’s recent turmoil has taken place] is not where they should be."

But according to several sources within SEIU, the union will be devoting resources to the Golden State this fall, even though the state is widely expected to remain a Democratic stronghold. The sources contend that the organization is preparing to deploy hundreds of its staffers to the region to take control of a local union affiliate and to deal with any potential fallout. At least some of those staffers, the sources say, would have been devoting their time and energy to the election campaign if not for SEIU’s internal troubles.

Last month the union’s international office was forced to "trustee," or take over, its largest California affiliate after the Los Angeles Times ran a series of articles exposing alleged corruption by its leader, Tyrone Freeman. Then, in late August, SEIU announced it was initiating a process to assume control of its second-largest California local, the Oakland-based United Healthcare Workers–West (UHW). For months, SEIU president Andy Stern has feuded with UHW head Sal Rosselli over Stern’s push to consolidate local union chapters into larger and more centralized units [see "A less perfect union," 4/9/08, and "The SEIU strikes back," 4/16/08].

Stern and the international have charged Rosselli and other UHW officials with misappropriating millions of dollars. In late July, a federal judge dismissed a lawsuit brought by SEIU covering these same charges. Now SEIU has scheduled its own hearings on the matter to decide whether to clean out UHW’s leadership. The hearings are set for Sept. 26-27 at the San Mateo County Event Center. A separate lawsuit challenging UHW leadership brought by individual UHW members is also moving forward. Rosselli and his supporters strongly deny the allegations of financial misconduct. They claim the upcoming trusteeship hearings are simply Stern’s latest attempt to stifle dissent within the union.

"It’s a kangaroo court," Rosselli told us. "It’s a purely political move to silence our members. And it’s a huge distraction."

SEIU’s turmoil is not welcome news to progressives. Federal election records show that the union’s political arm has dropped more than $10 million into Obama’s candidacy, as well as millions more for other left-wing candidates and causes. Beyond monetary support, Democrats are counting on SEIU organizers to hit the ground across the country, especially in hotly contested states like Pennsylvania, Florida, Ohio, Colorado, and Missouri. But because of the feud, a good number of those foot soldiers could be spending this autumn in safely blue California instead.

If the hearing officer hired by SEIU allows the union to take over UHW, another labor scholar, who spoke to the Guardian on condition of anonymity, said, "It’s hard to see how [SEIU] would do it without bringing in a significant number of people." He explained that in the event of a trusteeship, some or all of the staff may need to be replaced. The union also might have to contend with a large number of extremely disgruntled people in its 150,000-member affiliate.

Officials at UHW told us that members are planning "massive" demonstrations at the two-day hearings in late September. And the upheaval could easily drag on through the rest of the campaign season if the trusteeship moves forward. Rosselli predicts there will be "major resistance" from his rank and file. He would not elaborate on what that resistance would consist of, but a resolution passed at a recent UHW leadership conference struck a decidedly militant tone: "UHW will fight to keep our members united in one statewide healthcare workers union and will use all available means."

Rosselli told us that resisting SEIU’s trusteeship would "dramatically" curtail his local’s political activities. During the primary season, he added, UHW dispatched teams of organizers to Iowa, New Hampshire, and other critical states. But for the general election, they will be staying home. "We’re in a civil war," Rosselli said. "We need everyone here to defend against Stern’s dictatorship."

The Guardian has learned that Obama and other progressive candidates may not just be losing valuable campaigners from UHW. Several UHW sources said they expect SEIU to send large numbers of union organizers to the Bay Area in the wake of the hearings — and two management-level sources from the international’s staff confirmed those suspicions to us.

The first source, who asked not to be identified, told the Guardian that numerous colleagues at the organization have been approached by "senior international staff, attempting to recruit them and other organizers to come to California … to implement the [possible] trusteeship." The source added that people within the organization believe the union is planning to send "hundreds" of people.

A second management-level source at the international, who also requested anonymity, told us that they have personally assigned several organizers to campaign work only to see those staffers reassigned to the UHW matter by international higher-ups. The second source reiterated the first source’s contention that the union is looking to send "hundreds" of what the source termed "troops" to Northern California to replace any UHW staff who quit or are expelled, and to quell any uprising by disgruntled UHW members.

"This has been deemed an imperative at the top levels of the union," the second source continued. "People have been told [the] numbers of people they need to assign [to the UHW feud] and been told to look over their staff lists to see who they can assign."

Michelle Ringuette, a spokesperson for the international in Washington DC, told us that "no one is being pulled off of political work" to deal with the UHW situation. While she wouldn’t deny that some organizers who might otherwise be involved in lower-level political activities "like get out the vote operations" might be sent to California if needed, she denied that staffers who specialize in politics would be diverted or that hundreds of staffers would be involved. Get out the vote efforts such as phone banks and door-knocking are often performed by union workers on behalf of Democratic candidates — and they can be decisive in a close election.

"Of course this [the trusteeship hearing] is unfortunate timing," Ringuette said. "But … we don’t believe this is going to affect out advocacy for Barack Obama. That is our top national priority."

But a third employee of the international we spoke with rejected Ringuette’s description of a division of labor within the union’s organizers. The longtime employee, who also asked not to be identified for fear of retribution, told the Guardian that a small number of international staffers may specialize exclusively in political activism, but virtually all organizers would be working on the fall campaign in a normal election year.

"If they’re sending organizers to California [to deal with UHW], they’re definitely moving them away from battleground states. California is not considered a battleground state."

Our other two sources at the international echoed the third source’s characterizations.

In a strongly worded letter to Stern dated Sept. 9, UHW’s secretary treasurer Joan Emslie stated that the trusteeship hearings "can only distract" SEIU from political activism and "hinder our ability to put the greatest possible efforts into this critical national election." The letter ended by requesting that the trusteeship hearings be postponed until "a date no earlier than Nov. 10," one week after the presidential election. As of press time, the international has not rescheduled the hearings.

Obama campaign officials we contacted declined to comment on what one called "an internal union matter." But some labor observers were willing to voice their displeasure with the timing of the dispute. Professor Nelson Lichtenstein, director of the Center for the Study of Work, Labor, and Democracy at UC Santa Barbara called the trusteeship hearings "a huge mistake." With the upcoming election, Lichtenstein went on, "the consequences could be enormous. What’s the rush?"

PG&E’s PUC appointee

The Rules Committee of the Board of Supervisors voted Monday to forward the appointment of Nora Vargas to the SF Public Utilities Commission, without recommendation. The three supervisors on the committee (Tom Ammiano, Chris Daly, and Bevan Dufty) all expressed concern that Vargas’ lack of experience with local politics and public utilities issues might be a setback should she fill the seat.

Vargas is director of Latino Issues Forum, a statewide nonprofit advocacy group, with offices in Fresno, Los Angeles, and San Francisco. LIF works on healthcare reform, educational issues, and consumer rights for immigrants and Latino populations. Vargas would fill the ratepayer advocate seat on the PUC.

Vargas, when questioned by the Rules Committee, said she felt confident of her ability to act independently of her appointing authority, Mayor Gavin Newsom, and that she would put ratepayers and consumers first. When asked if she’d be able to push back against powerful entities like Pacific Gas and Electric, which takes an active interest in many things the SFPUC control, Vargas cited her experience advocating on behalf of ratepayers at the California Public Utilities Commission.

We know PG&E likes to spread their money and influence throughout the city. In this case, between 2004 and 2006, PG&E has given $150,000 to Latino Issues Forum, as part of their community grantmaking.

This is the same kind of giving that would presumably end should San Francisco voters approve the Clean Energy Act this November. “We no longer will be contributing to San Francisco’s non-profits and service organizations,” PG&E’s Brandon Hernandez told a June 27 meeting of the Rule Committee, at which they voted to put the Clean Energy Act on the November ballot. The measure calls for San Francisco to move toward 100 percent clean and renewable energy, possibly through public construction and ownership, thus putting PG&E out of business in this city.

Additionally, Guillermo Rodriguez, Jr., former public relations flak for PG&E, is on the board of Latino Issues Forum (along with two other private utility executives.) Rodriguez left PG&E to head the A. Philip Randolph Institute, which also receives lots and lots of PG&E’s money on a regular basis.

Vargas’ appointment to the SFPUC is up for approval by the full Board of Supervisors at today’s meeting, along with Newsom’s four other appointments – Ann Moller Caen, FX Crowley, Francesca Vietor, and Dick Sklar. Sklar, at the last PUC meeting, withdrew his candidacy for the seat.
