Saving Lyon-Martin

When word got out that the Lyon-Martin Health Services clinic faced imminent closure, Luette Chavez’s cell phone started ringing off the hook. Her friends were going into panic mode.

“It’s shocking to think that something that’s so important to so many people could just be lost so easily,” Chavez told us. The clinic serves nearly 2,500 patients, regardless of their ability to pay for health care. It offers specialized services for queer women and transgender people, providing everything from primary care to mental health services to hormone treatment. A Hurricane Katrina survivor, medical school student, and part-time sex worker, Chavez volunteers at the clinic and relies on it for health care. Her dream is to someday start a free clinic in New Orleans that is cast in the mold of Lyon-Martin. But for now, all of her energy is consumed with the widespread effort to raise enough money to keep the clinic afloat. To survive, Lyon-Martin must pay off a $250,000 debt immediately.

 

CASH FLOW PROBLEM

As one volunteer among many, Chavez has adopted the mindset that failure is not an option. “I have absolutely every confidence that we will be able to save it ourselves because we’re running ourselves into the ground doing it,” she said.

Lyon-Martin’s board of directors initially voted to shut down the clinic at the close of business Jan. 27, citing insurmountable financial problems. That decision was rescinded, however, following an emergency meeting held at the LGBT Center shortly after news of its pending closure went viral. By Jan. 28, an emergency fund drive had netted close to $100,000 in pledges and cash donations. A fundraiser held Jan. 30 at El Rio drew nearly 700 supporters and roped in another $28,000.

Despite the outpouring of support, the long-term future of the 30-year-old clinic remains uncertain. Lyon-Martin can restructure and avoid shutdown if it manages to clear the $250,000 urgently owed, but it must find $500,000 to continue operating in the same capacity as it has. It has stopped accepting new patients, but will likely be able to serve current patients until at least the end of February.

“Without Lyon-Martin, a community that is historically marginalized won’t have anywhere to turn,” stated an open letter to supporters from Board Chair Lauren Winter, who was unavailable for comment.

A combination of state funding cuts, increased demand, and poor financial management created a perfect storm for Lyon-Martin. A key source of the trouble was that the clinic had not been keeping up with its billing, and after a certain amount of time, it could no longer claim reimbursements from Medi-Cal. Yet external factors such as state and local budget cuts contributed to the problem, too, and Lyon-Martin is not alone in that respect.

All across San Francisco, community clinics that serve low-income and uninsured people are struggling to do more with less. Jim Illig, president of the San Francisco Health Commission, told us that he knows of several other clinics in dire financial straits.

“There are a lot of clinics on the edge because they have dedicated their mission to serving the uninsured,” he said. “Any nonprofit clinic that you see — they’re struggling.” The Haight Ashbury Free Clinics, another nonprofit healthcare organization serving the uninsured, recently announced a merger with Walden House, a substance-abuse treatment center. The merger allowed the venerable health-care nonprofit to continue offering services after its budget was slashed by 50 percent due to reduced support from the city’s General Fund. Even as the cuts took effect, demand for the free clinic’s services rose 10 percent from 2009 to 2010.

“Every time I look into the waiting room, it’s full,” said Jeff Schindler, chief development officer.

If Lyon-Martin closes, its patients will have to be transferred to other clinics, but there’s high demand everywhere. Such an outcome might evoke a sense of dèjá vu for some. Last fall, when an LGBT-focused clinic called New Leaf shut down due to crippling financial problems, many of its clients were transferred to Lyon-Martin.

 

COMMUNITY SURPRISED, UPSET

The front office manager at Lyon-Martin, who wished to be identified only as Braz, said she’d had no warning that closure was imminent. “Just closing down like that seemed impossible. We couldn’t ethically do that,” she said. “Our patients are freaking out right now.”

Once people became aware that the clinic was on the brink of closure, some aired the criticism that the board should have been more forthright about financial troubles. The Bay Area Reporter, a San Francisco publication covering LGBT issues, published an editorial calling for the resignation of the six-member board, and several sources told the Guardian they expected the board members to step down.

Meanwhile, health officials and elected representatives have stepped into the mix, but no promises of governmental financial assistance had been secured by the time the Guardian went to press.

Department of Public Health Director Barbara Garcia was unavailable for comment, but released a prepared statement: “The Department of Public Health has been in close discussions with Lyon-Martin and the pressing need to make immediate changes to the way they conduct their financial affairs. We value the important health care services they deliver and will continue to work with them to find the best long-term outcome for the clinic and the patients.”

Sup. Scott Wiener told the Guardian that he’d been in discussions about Lyon-Martin with Garcia and Sup. David Campos. Sups. Ross Mirkarimi and Jane Kim also attended the emergency meeting, and California Sen. Mark Leno was said to be attempting to secure some state funding for the clinic. As the push to save the clinic continues, a parallel effort is moving forward to craft a contingency plan for how Lyon-Martin’s nearly 2,500 patients can access care in the event that it doesn’t survive.

 

COMPETENT CARE

Lyon-Martin patients and others familiar with its services stressed that the women’s clinic is a critical resource for lesbians and the transgender population, because medical staff are trained in that specialized area of care.

“The service there is incredible,” noted Cheryl Simas, who has been a patient there for three years. “They explain everything to you, you’re listened to, and you’re treated with care and respect.” Simas said it was a dramatic difference from an experience she’d had in the mid-1990s, when her healthcare provider was barely comfortable pronouncing the word “lesbian.”

Lyon-Martin medical staffers receive training on transgender patient care, and it even offers training in that realm for medical professionals from cities throughout the United States. “They are internationally renowned as a model for what it means to offer transgender care,” noted labor organizer Gabriel Haaland, who said he was once denied health care due to his transgender identity. “The healthcare system is a fairly traumatic experience for most transgender people,” he added.

If Lyon-Martin closed, “it’d be pretty tragic,” noted Carlina Hansen, executive director of the Women’s Community Clinic, which works closely with Lyon-Martin. When it comes to health care, “We live in an unusual city, in that there is a lot of need among low-income people, due in part to a high cost of living. “Every clinic in San Francisco provides an integral part of that network,” and each clinic fills a specific need, Hansen noted. “The diversity of the clinics matches the diversity of our community.”

The price of mental health cuts

OPINION The massacre in Tucson is a tragic wake-up call for the public mental health system of our own county. Among the many pressing angles to the story, it is vital to consider the severe cuts to mental health services in Pima County last year.

Although only a small fraction of the mentally ill commit acts of violence, we must contemplate the larger issue of what happens when a community fails to prioritize mental health. Acute mental health services are such an essential tool for caring for the severely mentally ill that one is staggered by the low priority they’ve been given by our forward-thinking community in San Francisco.

Throughout the nation, the mentally ill are among our most disenfranchised constituents. In San Francisco, a considerable fraction of our severely mentally ill populations are indigent, homeless, and without health insurance. Acute care services for the mentally ill therefore lose money. In these hard financial times, city officials, like those in Pima County, are making painful decisions. Over the past three years, mental health services in San Francisco have been cut to austerity levels.

To see the short-sightedness of these cuts, one must consider not only the most drastic scenarios. For every Jared Loughner, there are thousands of individuals whose profound burdens could be alleviated with the help of these services. Inpatient psychiatry at San Francisco General Hospital provides the highest level of mental health care in our county. Unlike private hospitals, SFGH takes all patients, regardless of their insurance, and regardless of the risk of violence. The inpatient service at SFGH provides the only safety net for those patients who are the most extreme danger to themselves and others.

From 2008 to 2010, the number of acute psychiatry beds at SFGH was cut from 84 to 42. The consequences of the cuts were palpable. They led to the disintegration of the Cultural Focus Program, a nationally-recognized model of ethical inpatient psychiatric care. The most ill patients were crowded onto two remaining acute units. The staff was then put in the position of having to move patients to understaffed units, so-called subacute, before they were clinically ready.

In January, one of two remaining acute psychiatry units at SFGH was cut. This leaves 21 acute beds available to the entire city. It’s now impossible to separate the most violent patients. The unit has become hyperacute, with an increasingly agitated population amplifying itself. Staff feel unsafe and cannot provide adequate care for their patients. As they grapple with understaffing, many cite what happened at Napa State Hospital recently when a psychiatric worker was murdered — an incident attributed to understaffing.

Meanwhile, there is considerable pressure to discharge these patients quickly. A vast number end up on the streets, in jails, overwhelming outpatient programs, or bouncing back to the emergency room — racking up even higher costs.

Due to budgetary pressures, the Department of Public Health insists that our unstable patients should be funneled into outpatient services. While outpatient programs provide vital means for supporting the chronically mentally ill when they are stable, they are also being cut — and are insufficient to protect acute patients.

These budget cuts make it plain that we are dealing with a clumsy model of mental health — one that lacks essential mechanisms. Such a model reflects a poor understanding of mental illness.

Arizona provides a clarion call to California: we must hear the implicit warning. These cuts to acute mental health services in San Francisco, a city with a large mentally ill population, must be reversed. Each day that they persist heightens the very real tragedy for our patients, our healthcare workers, and our entire community. *

Why I may run for Congress

OPINION One of the most inspiring political leaders in recent decades, Sen. Paul Wellstone (D-Minn.), famously declared: “I represent the democratic wing of the Democratic Party.” Today we need progressives in Congress who will represent the progressive wing of the Progressive Caucus.

That’s the largest caucus on Capitol Hill — but having 80 members on the roster won’t do much good if many cave under pressure.

For 18 years, the North Bay has been represented in Congress by Rep. Lynn Woolsey. Her strong antiwar voice and very progressive voting record have endeared her to a lot of constituents. Now she’s publicly saying that she may choose to retire instead of seeking reelection.

This week, after decades of working for progressive social change, I’m announcing a federal exploratory committee for Congress (www.NormanSolomonExploratory.com). If Rep. Woolsey doesn’t run in 2012, I will.

Across the country, alarm is rising as corporate power escalates at the intersection of Wall Street and Pennsylvania Avenue. An egregious factor is the deference to such power from some elected officials who rely on a progressive base for votes but shrug off tangible accountability to that base.

Dysfunctional relationships between liberals in Congress and progressive social movements serve as enablers for endless war, massive giveaways to Wall Street, widening gaps between the rich and the rest of us, erosion of civil liberties, outrageous inaction on global warming, and so much more.

Back in congressional districts, the only way to beat corporate Astroturf is with genuine grassroots activism — committed to creating a very different kind of future for the next generations.

At a time when high unemployment is becoming more protracted in tandem with a gargantuan warfare state, we’re in the midst of what Martin Luther King Jr. called “the madness of militarism.”

So-called moderates are adept at fine-tuning rather than challenging a destructive status quo. But there’s nothing moderate about helping to fuel the engines of social inequity, eco-disaster and perpetual war.

Eight decades ago, much of the U.S. press was hostile to a new president named Franklin D. Roosevelt, and many of his political enemies called him a dangerous radical. But there was — and is — nothing unduly radical about supporting economic fairness and social justice.

Before the end of his first term, FDR denounced “the economic royalists.” He said: “They are unanimous in their hate for me — and I welcome their hatred.” He did not say, “They hate me — and I want them to like me.”

Today, big money and mega-media power are dominant; yet progressives who are principled, determined, and methodical can prevail in a big way. That’s what happened last year when activists defeated PG&E’s monopolistic Proposition 16 despite being outspent by more than 400 to 1.

Living in the North Bay for more than a dozen years, I’ve often been moved by the extent of local progressive passions. Antiwar, environmental, and social justice outlooks are widespread — and deserve forthright representation in Congress.

Paul Wellstone was vitally correct when he said: “In the last analysis, politics is not predictions and politics is not observations. Politics is what we do. Politics is what we do, politics is what we create, by what we work for, by what we hope for, and what we dare to imagine.”

Lyon Martin clinic facing closure

Lyon Martin Health Services — a legendary health clinic that specializes in women’s and LGBT health, celebrating its 30th anniversary last year — is having serious financial problems and could close down as soon as Thursday.

Rumors of the closure have been circulating all day, with Sup. Scott Wiener telling the SF Appeal that a source told him the clinic was closing. And the Guardian has now learned that at least one patient, health educator Catie Magee, had an appointment for Monday canceled by the clinic and was told, “We have to cancel your appointment because Lyon Martin is closing.”

The clinic is the only free-standing community clinic in California that serves to women and transgender people in a place sensitive to sexual and gender identity. The non-profit closure of the clinic would be a great loss to the community since it also provides healthcare regardless of one’s ability to pay.

“If you’re uninsured and your trans or a lesbian, you’ve probably been to Lyon Martin,” transgender labor organizer Gabriel Haaland, who used the clinic for his transition in 1997, told us. Unlike most medical providers, he said Lyon Martin offered hormone shots and other services to anyone who sought them “without making you jump through a whole bunch of hoops.”

Haaland and other supporters of the center plan to gathered tonight at 7 pm in Room 301 of the LGBT Center (1800 Market) to discuss the center and what can be done to save it.

The clinic’s namesakes, pioneering lesbian and feminist activists Del Martin and Phyllis Lyon, were the first same-sex couple to be issued a marriage license by the city back in 2004, and they were married by then-Mayor Gavin Newsom on Feb. 16, 2004,

In the past year, the clinic served 2,500 patients. Elizabeth Sekera, the clinic director told us that the clinic even sees patients outside the county of San Francisco and unfortunately if the clinic closes, those patients won’t even be covered under the city’s health access program, Healthy San Francisco, since they do not live here.

Sekera said she was unable to comment on why and when the clinic will be closed. She also did not give any information on where patients would be referred to but did say that the staff at Lyon Martin has opposed the closure of the clinic because there isn’t a transition of care plan and the abandonment of patients is unethical.

It is uncertain whether the clinic, which is funded solely by donations, is closing due to funds. The clinic is run by about 23 staff members, interns, and lots of volunteers. The support section in its website pleads, “We need your help! We need it now.”

Magee said the loss of Lyon Martin would be huge blow to the city, particularly after New Leaf, which also served an LGBT clientele, closed last year. “It’s a shame,” Magee said, noting Lyon Martin’s excellent “reputation as a place for women’s and LGBT healthcare.”

Charlene Hawek, who has been a patient at the clinic for two years, expressed concern for where she will go if the clinic does close. When asked if there is any other option she responded, “There’s the Tom Waddell center but it’s not the same.”

Sekera hopes to see the clinic “remain open, possibly under a different name, or a full institution to exist in the same state, live for another 30 years.”

The cruelest cuts

OPINION Sitting alone in my apartment off Turk and Mason streets in San Francisco’s Tenderloin district, I try not to let myself slip back into depression or anxiety over my finances. My apartment is small, an adjective that makes it sound bigger than it really is. Still, it’s mine. I am able to pay rent through my Supplemental Security Income (SSI) check, and when my disability claim was first approved, I was relieved.

It had been a nearly two-year uphill battle with the Social Security Administration, and even after my benefits were approved, I still spent an additional three months living out of various shelters while I waited on several housing lists. But then the call came from my social worker at the shelter that I had been placed in a hotel in the Tenderloin, and I was excited to be out of shelters once and for all.

I am not someone who is easily given over to making hyperbolic statements, so I cannot say that I was ever happy to have to be living off SSI. Nevertheless, I was happy to have a roof over my head rather than a rain-soaked cardboard box, and I was thankful to have Medi-Cal. After all, San Francisco is just about the only place where transgender woman like myself can get affordable or free healthcare and be treated with dignity from our providers.

Little did I realize that being treated with dignity by our government was no longer in the cards.

It began when many of my friends, also on SSI or Social Security Disability Insurance (SSDI), started complaining about reductions to their checks. Our benefits were cut — but the Social Security Administration wasn’t telling us what had happened. Some checks were cut by as little as $20, some $60, and others as much as $150.

My check was unaffected for a few months, and then the cuts started to hit me as well. I have now seen six separate reductions to my monthly check, which was $964, and is now only $845. Because of the cuts, I no longer have enough to meet all of my basic needs each month. Many days, dinner is a loaf of warmed up garlic bread because it’s all I can afford.

But things got much worse. The government did the most inhumane thing imaginable: it took away vision and dental benefits from our Medi-Cal. Suddenly, three epiphanies about politics dawned on me: the first that the poor are sound bites for politicians; it always looks good for politicians to get their picture in the local newspaper with their arm around a smiling 60-something homeless guy. Second, the poor will always be the first minority group to have their funding for social service programs, essential food services, and low-cost or free medical care targeted in a bad economy.

The last thing I realized is that politicians don’t care if the poor die — as long as they die silently and the politicians don’t get blamed for it.

These days I wonder if I’ll even be able to keep my housing, and I often have anxiety attacks where my heart races and I cry to myself, just out of sheer stress and worry.

The fact is, I shouldn’t have to live this way. I have to wonder how amounts so small in proportion to California’s $25 billion deficit are even going to come close to making a difference.

It’s unconscionable that the first thought of our government would be to steal from those who are already disabled and poor and barely getting by, those who really don’t know how to advocate for themselves, and who have few allies to begin with. *

They have issues: Members of the new Board speak

Board President David Chiu touched off a broad political discussion in recent weeks with his statement that officials were elected “not to take positions, but to get things done.” Delivered just before his reelection as Board President with the solid backing of the board’s moderate faction, Chiu’s comment has been viewed in light of City Hall’s shifting political dynamic, a subject the Guardian explores in a Jan. 19 cover story. Politics aside, Chiu’s statement also begs the question: Just what do members of the board hope to get done, and how do they propose to accomplish the items on their agenda?
Last week, Guardian reporters tracked down every member of the board to find out. We asked, what are your top priorities? And how do you plan to achieve them? Some spoke with us for 25 minutes, and others spoke for just 5 minutes, but the result offers some insight into what’s on their radar. Not surprisingly, getting the budget right was mentioned by virtually everyone as a top priority, but there are sharp differences in opinion in terms of how to do that. Several supervisors, particularly those in the moderate wing, mentioned ballooning pension and healthcare costs. Aiding small business also emerged as a priority shared by multiple board members.

District 1

Elected in 2008 to represent D1, Sup. Eric Mar has been named chair of the powerful Land Use & Economic Development Committee and vice chair of the City Operations and Neighborhood Services Committee.

Asked to name his top priorities, Mar said, “A humane budget that protects the safety net and services to the must vulnerable people in San Francisco is kind of the critical, top priority.”

It’s bound to be difficult, he added. “That’s why I wish it could have been a progressive that was chairing the budget process. Now, we have to work with Carmen Chu to ensure that it’s a fair, transparent process.”

A second issue hovering near the top of Mar’s agenda is lending a helping hand to the small businesses of the Richmond District. “There’s a lot of anxiety about the economic climate for small business. We’re trying to work closely with some of the merchant associations and come up with ideas on how the city government can be more supportive,” he said. Mar also spoke about the need to respond to the threat of big box stores, such as PetCo, that could move in and harm neighborhood merchants. “I’m worried about too many of the big box stores trying to come in with an urban strategy and saying that they’re different — but they sure have an unfair advantage,” he noted.

Programs and services for the senior population ranked high on his list. Mar noted that he’d been working with senior groups on how to respond to a budget analyst’s report showing a ballooning need for housing – especially affordable housing – for seniors. “It’s moving from the Baby Boom generation to the Senior Boomers, and I think the population, if I’m not mistaken, by 2020 it’s going up 50 percent,” he said. “It’s a huge booming population that I don’t think we’re ready to address.”

Addressing food security issues through the Food Security Task Force also ranked high on Mar’s list, and he noted that he’s been working with a coalition that includes UCSF and the Department of Public Health to study the problem. “We’ve had a number of strategy meetings already, but we’re trying to launch different efforts to create healthier food access in many of our lowest income neighborhoods,” Mar said.

Finally, Mar talked about issues relating to the park. “I do represent the district that has Golden Gate Park, so I’m often busy with efforts to preserve the park, prevent privatization, and ensure enjoyment for the many residents not just in the Richmond but throughout the city that enjoy the park.” Although it’s not technically in his district, Mar noted that he is very supportive of HANC Recycling Center – and plans to advocate on their behalf to Mayor Lee.

District 2

Elected to replace termed-out D2 Sup. Michela Alioto-Pier, Farrell has been named vice-chair of the Government Audits & Oversight Committee and a member of the Rules Committee. A native of D2, Farrell told the Guardian he believes his roots in the city and background as a venture capitalist would be an asset to the city’s legislative body. “I know at the last board, Carmen [Chu] was the only one who had any finance background,” he said. “To have someone come from the private sector with a business / finance background, I really do believe … adds to the dialogue and the discussion here at City Hall.”

Along those lines, Farrell said one of his top priorities is the budget. “I’m not on the budget and finance committee this time around, but given my background, I am going to play a role in that,” he said.

So what’s his plan for closing the budget deficit? In response, he alluded to slashing services. “In the past, there have been views that we as a city don’t provide enough services and we need to raise revenues to provide more, or the perspective that we first need to live within our means and then provide more services. Everyone’s going to disagree, but I’m in the latter camp,” he said. “I do believe we need to make some tough choices right now – whether it be head count, or whether it be looking at …pension reform. I do believe pension reform needs to be part of the dialogue. Unfortunately, it’s unsustainable.”

He also said he wanted to be part of “trying to create and focus on a framework for a long-term financial plan here in San Francisco.”

Secondly, Farrell discussed wanting to put together a “jobs bill.”

“Jobs is a big deal,” he said. “It’s something I want to focus on. There are only so many levers we can pull as a city. I think the biotech tax credits have spurred a lot of business down in Mission Bay.”

Next on Farrell’s agenda was quality-of-life issues, but rather than talk about enforcing San Francisco’s sit/lie ordinance – supported by political forces who organized under the banner of maintaining ‘quality-of-life’ – Farrell revealed that he is incensed about parking meter fines. “It is so strikingly unjust when you are 1 minute late to your parking meter and you have a $65 parking fine,” he said.

Farrell also mentioned development projects that would surely require time and attention. “CPMC is going to be a major dominant issue,” he said. He also mentioned Doyle Drive, and transitional age youth housing projects proposed in D2 – but as far as the housing project planned for the King Edward II Inn, which has generated some controversy among neighborhood groups, he didn’t take a strong position either way, saying he wanted to listen to all the stakeholders first.

Elected for a second two-year term as President of the Board, D3 Sup. David Chiu is rumored to be running in the mayor’s race, after he turned down former Mayor Gavin Newsom’s offer to appoint him as District Attorney. That offer was made after Kamala Harris won the state Attorney General’s race this fall. And when Chiu turned it down, former Mayor Gavin Newsom shocked just about everybody by appointing San Francisco Police Chief George Gascon, who is not opposed to the death penalty and was a longtime Republican before he recently registered as a Democrat, instead.

A temporary member of the Board’s Budget acommittee, Chiu is also a permanent member of the Board’s Government Audits & Oversight Committee.

Asked about his top priorities, Chiu spoke first and foremost about  “ensuring that we have a budget that works for all San Franciscans, particularly the most vulnerable.” He also said he wanted to see a different kind of budget process: “It is my hope that we do not engage in the typical, Kabuki-style budget process of years past under the last couple of mayors, where the mayor keeps under wraps for many months exactly what the thinking is on the budget, gives us something on June 1 for which we have only a couple of weeks to analyze, and then engage in the tired back-and-forth of debates in the past.” Chiu also spoke about tackling “looming pension and health care costs.”

Another priority, he said, was “Ensuring that our neighborhoods continue to remain the distinctive urban villages that they are, and protecting neighborhood character,” a goal that relates to “development, … historic preservation, [and] what we do around vacant commercial corridors.”

*Immigrant rights also made his top-five list. “I was very sad that last November we didn’t prevail in allowing all parents to have a right and a voice in school board elections,” he said, referencing ballot measure Proposition D which appeared on the November 2010 ballot. “I think we are going to reengage in discussion around Sanctuary City, another topic I have discussed twice already with Mayor Lee.”

Another issue for Chiu was  “ensuring again that hopefully San Francisco continues to remain an economically diverse city, and not just a city for the very wealthy.” He spoke about reforming city contracts: “In particular, dealing with the fact that in many areas, 70 to 80 percent of city contracts are awarded to non-San Francisco businesses. … I think there is more significant reform that needs to happen in our city contracting process.” Another economic-diversity measure, he said, was tax policy, “particularly around ensuring that our business tax is incenting the type of economic growth that we want.”

Finally, Chiu spoke about “Creating a transit-first city. This is not just about making sure MUNI is more reliable and has stable funding, but ensuring that we’re taking steps to reach a 2020 goal of 20 percent cycling in the city. Earlier this week I called for our transit agencies to look at pedestrian safety, because we are spending close to $300 million a year to deal with pedestrian deaths and injuries.”

Chiu has just named Sup. Carmen Chu as chair of the powerful Board and Finance Committee. And Chu, who worked as a budget analyst for Newsom’s administration, says the budget, core services, employment and the economy are her top priorities.

“My hope is that this year the budget is going to be a very collaborative and open process,” Chu said.

Chu believes workers benefits will be a central part of the budget-balancing debate.
“Any conversation about the long-term future of San Francisco’s budget has to look at the reality of where the bulk of our spending is,” she said.

Chu noted that the budget debate will have to take the state budget into account.
“At the end of the day, we need to take into account the context of the state budget, in terms of new cuts and taxes, because anything we do will be on top of the state level.

“We need to ask who do these measures really impact,” she added, noting that there were attempts to put revenue measures on the ballot last year.

With only two years left to serve on the Board, D5 Sup. Ross Mirkarimi has been named chair of the Board’s Public Safety Committee and vice-chair of the Budget and Finance Committee.

“One of my top priorities is building on and strengthening the work that I’ve already done and that Avalos is doing on mandatory local hire and First Source programs,” Mirkarimi said. He also spoke about “strengthening reentry programs for those coming out of the criminal justice system, because we still have an enormously high recidivism rate.”

The budget also ranked high on Mirkarimi’s list, and he stressed the need for “doing surgical operations on our budget to make sure that services for the vulnerable are retained, and looking for other ways to generate revenue beyond the debate of what’s going on the ballot.

“For instance, I helped lead the charge for the America’s Cup, and while the pay-off from that won’t be realized for years, the deal still needs to be massaged. What we have now is an embryonic deal that still needs to be watched.”

Mirkarimi mentioned safeguarding the city against privatization, saying one of his priorities was “retooling our budget priorities to stop the escalating practice of privatizing city services.”

 He spoke about “ongoing work citywide to make mixed-use commercial and residential infrastructure improvements, which coincide with bicycle and pedestrian improvements.”

Finally, Mirkarimi said he wanted to focus on transportation issues. “As Chair of the Transportation Authority, if I even continue to be chair, to take the lead on signature transit projects and work with the M.T.A. to reverse service cuts.”

Elected to replace termed-out D6 Sup. Chris Daly, Kim has been named chair of the Rules Committee and a member of the Budget & Finance committee.

Kim believes that she will prove her progressive values through her work and she’s trying to take the current debate about her allegiances on the Board in her stride.

“The one thing I learned from serving on the School Board was to be really patient,” Kim told me, when our conversation turned to the issue of “progressive values.”

“I didn’t want to be President of the School Board for the first few years, because I loved pushing the envelope,” Kim added, noting that as Board President David Chiu is in the often-unenviable position of chief negotiator between the Board and the Mayor.

But with Ed Lee’s appointment as interim mayor, Kim is excited about the coming year.
“There are a lot of new opportunities, a different set of players, and it’s going to be very interesting to learn how to traverse this particular scene.”

Kim is kicking off her first term on the Board with two pieces of legislation. The first seeks to address bedbug infestations. “Particularly around enforcement, including private landlords,” Kim said, noting that there have also been bedbug problems in Housing Authority properties.

Her second immediate goal is to look at pedestrian safety, a big deal in D6, which is traversed by freeways with off-ramps leading into residential zones.
“Pedestrian safety is a unifying issue for my district, particularly for all the seniors,” Kim said, citing traffic calming, speed limit enforcement and increased pedestrian traffic, as possible approaches.

Beyond those immediate goals, Kim plans to focus on jobs, economic development and small businesses in the coming year. “What can we do to create jobs and help small businesses? That is my focus, not from a tax reduction point of view, but how can we consolidate the permitting and fees process, because small businesses are a source of local jobs.”

Kim plans to help the Mayor’s Office implement Sup. John Avalos’ local hire legislation, which interim Mayor Ed Lee supports, unlike his predecessor Mayor Gavin Newsom.

“Everyone has always liked the idea of local hire, but without any teeth, it can’t be enforced,” Kim observed. “It’s heartbreaking that young people graduate out of San Francisco Unified School District and there’s been not much more than retail jobs available.”

She noted that jobs, land use and the budget are the three overarching items on this year’s agenda. “I’m a big believer in revenue generation, but government has to come half-way by being able to articulate how it will benefit people and being able to show that it’s more than just altruistic. I think we have to figure out that balance in promoting new measures. That’s why it’s important to be strong on neighborhood and community issues, so that folks feel like government is listening and helping them. I don’t think it’s a huge ask to be responsive to that.”

Kim said she hoped the new mayor would put out a new revenue measure, enforce local hire, and implement Sup. David Campos’ legislation to ensure due process for immigrant youth.

“I think Ed can take a lot of the goodwill and unanimous support,” Kim said. “We’ve never had a mayor without an election, campaigns, and a track record. Usually mayors come in with a group of dissenters. But he is in a very unique position to do three things that are very challenging to do. I hope raising revenues is one of those three. As a big supporter of local hire, I think it helps having a mayor that is committed to implement it. And I’m hoping that Ed will implement due process for youth. For me, it’s a no brainer and Ed’s background as a former attorney  for Asian Law Caucus is a good match. Many members of my family came to the U.S. as undocumented youth, so this is very personal. Kids get picked up for no reason and misidentified. People confuse Campos and Avalos, so imagine what happens to immigrant youth.”

District 7

With two years left to serve on the Board, D7 Sup. Sean Elsbernd has been named vice-chair of the Rules Committee and a member of the City Operations & Neighborhood Services Committee. He was congratulated by Chinatown powerbroker Rose Pak immediately after the Board voted 11-0 to nominated former City Administrator Ed Lee as interim mayor, and during Lee’s swearing-in, former Mayor Willie Brown praised Elsbernd for nominating Lee for the job.

And at the Board’s Jan. 11 meeting before the supervisors voted for Lee, Elsbernd signaled that city workers’ retirement and health benefits will be at the center of the fight to balance the budget in the coming year.

Elsbernd noted that in past years, he was accused of exaggerating the negative impacts that city employees’ benefits have on the city’s budget. “But rather than being inflated, they were deflated,” Elsbernd said, noting that benefits will soon consume 18.14 percent of payroll and will account for 26 percent in three years. “Does the budget deficit include this amount?” he asked.

And at the afterparty that followed Lee’s swearing in, Public Defender Jeff Adachi, who caused a furor last fall when he launched Measure B, which sought to reform workers’ benefits packages, told the Guardian he is not one to give up lightly. “We learned a lot from that,” Adachi said. “This is still the huge elephant in City Hall. The city’s pension liability just went up another 1 percent, which is another $30 million.”

As for priorities, Elsbernd broke it down into district, city, and regional issues. In D7, “Hands-down, without question the biggest issue … is Parkmerced,” he said, starting with understanding and managing the environmental approval process. If it gets approved, he said his top concerns was that “the tenant issue. And the overriding concern of if they sell, which I think we all think is going to happen in the near-term – do those guarantees go along with the land?”

Also related to Parkmerced was planning for the traffic conditions that the development could potentially create, which Elsbernd dubbed a “huge 19th Avenue issue.”

Citywide, Elsbernd’s top priorities included enforcing Proposition G – the voter-approved measure that requires MUNI drivers to engage in collective bargaining – and tackling pension and healthcare costs. He spoke about “making sure that MTA budget that comes to us this summer is responsive” to Prop G.

As for pension and healthcare, Elsbernd said, “I’ve already spent a good deal of time with labor talking about it, and will continue to do that.” But he declined to give further details. Asked if a revenue-generating measure could be part of the solution to that problem, Elsbernd said, “I’m not saying no to anything right now.”

On a regional level, Elsbernd’s priority was to help CalTrain deal with its crippling financial problem. He’s served on that board for the last four years. “The financial situation at CalTrain – it is without question the forgotten stepchild of Bay Area transit, and the budget is going to be hugely challenging,” he said. “I think they’ll survive, but I think they’re going to see massive reductions in services.”

Sup. Scott Wiener
District 8

Elected in November 2010 to replace termed-out D8 Sup. Bevan, Wiener has been named a temporary member of the Board’s Budget and Finance Committee and a permanent member of the Land Use and Economic Development Committee.

“Transportation is a top priority,” Wiener said. ‘That includes working with the M.T.A. to get more cabs on the street, and making sure that the M.T.A. collectively bargains effectively with its new powers, under Prop. G.”

“I’m also going to be focusing on public safety, including work around graffiti enforcement, though I’m not prepared to go public yet about what I’ll be thinking,” he said.

“Regulating nightlife and entertainment is another top priority,” Wiener continued. “I want to make sure that what we do is very thoughtful in terms of understanding the economic impacts, in terms of jobs and tax  revenues, that this segment has. With some of the unfortunate incidents that have happened, it’s really important before we jump to conclusions that we figure out what happened and why. Was it something the club did inappropriately, or was it just a fluke? That way, we can avoid making drastic changes across the board. I think we have been very reactive to some nightclub issues. I want us to be more thoughtful in taking all the factors into consideration.”

“Even if we put a revenue measure on the June or November ballot, we’d need a two-thirds majority, so realistically, it’s hard to envision successfully securing significant revenue measure before November 2012,” Wiener added. “And once you adopt a revenue measure, it takes time to implement it and revenue to come in, so it’s hard to see where we’ll get revenue that will impact the 2012 fiscal year. In the short term, for fiscal year 2011/2012, the horse is out of the barn”

“As for pension stuff, I’m going to be very engaged in that process and hopefully we will move to further rein in pension and retirement healthcare costs.”

District 9

Elected in 2008, D9 Sup. David Campos has been named chair of the Board’s Government Audit & Oversight Committee and a member of the Public Safety Committee. And, ever since he declared that the progressive majority on the Board no longer exists, in the wake of the Board’s 11-0 vote for Mayor Ed Lee, Campos has found his words being used by the mainstream media as alleged evidence that the entire progressive movement is dead in San Francisco.

“They are trying to twist my words and make me into the bogey man,” Campos said, noting that his words were not a statement of defeat but a wake-up call.

“The progressive movement is very much alive,” Campos said. “The key here is that if you speak your truth, they’ll go after you, even if you do it in a respectful way. I didn’t lose my temper or go after anybody, but they are trying to make me into the next Chris Daly.”

Campos said his overarching goal this year is to keep advancing a good government agenda.

“This means not just making sure that good public policy is being pursued, but also that we do so with as much openness and transparency as possible,” he said.

As a member of the Board’s Public Safety Committee, Campos says he will focus on making sure that we have “as much community policing as possible.

He plans to focus on improving public transportation, noting that a lot of folks in his district use public transit.

And he’d like to see interim mayor Ed Lee implement the due process legislation that Campos sponsored and the former Board passed with a veto-proof majority in 2009, but Mayor Gavin Newsom refused to implement. Campos’ legislation sought to ensure that immigrant youth get their day in court before being referred to the federal immigration authorities for possible deportation, and Newsom’s refusal to implement it, left hundreds of youth at risk of being deported, without first having the opportunity to establish their innocence in a juvenile court.
‘We met with Mayor Lee today,” Campos told the Guardian Jan. 18. “And we asked him to move this forward as quickly as possible. He committed to do that and said he wants to get more informed, but I’m confident he will move this forward.”

Campos also said he’ll be focusing on issues around workers’ rights and health care.
“I want to make sure we keep making progress on those fronts,” Campos said.

“It’s been a rough couple of days,” Campos continued, circling back to the beating the press gave him for his “progressive” remarks.“But I got to keep moving, doing my work, calling it as a I see it, doing what’s right, and doing it in a respectful way. The truth is that if you talk about the progressive movement and what we have achieved, which includes universal healthcare and local hire in the last few years, you are likely to become a target.”

District 10

Elected to replace termed-out D10 Sup. Sophie Maxwell, Cohen has been named chair of the City & School District committee, vice chair of the Land Use and Economic Development Committee and vice chair of the Public Safety Committee.

Cohen says her top priorities are public safety, jobs, open space, which she campaigned on, as well as creating community benefits districts and putting an end to illegal dumping.

“I feel good about the votes I cast for Ed Lee as interim mayor and David Chiu as Board President. We need to partner on the implementation of local hire, and those alliances can help folks in my district, including Visitation Valley.”

“I was touched by Sup. David Campos words about the progressive majority on the Board,” she added. “I thought they were thoughtful.”

Much like Kim, Cohen believes her legislative actions will show where her values lie.
“I’d like to see a community benefits district on San Bruno and Third Street because those are two separate corridors that could use help,” Cohen said. 

She pointed to legislation that former D10 Sup. Sophie Maxwell introduced in November 2010, authorizing the Department of Public Works to expend a $350,000 grant from the Solid Waste Disposal Clean-Up Site trust fund to clean up 25 chronic illegal dumping sites.
“All the sites are on public property and are located in the southeast part of the city, in my district,” Cohen said, noting that the city receives over 16,000 reports of illegal dumping a year and spends over $2 million in cleaning them up.

District 11

Sup. John Avalos, who chaired the Budget committee last year and has just been named Chair of the Board’s City Operations and Neighborhood Services Committee, said his top priorities were implementing local hire, improving Muni and Balboa Park BART station, building affordable housing at Balboa, and improving city and neighborhood services.

“And despite not being budget chair, I’ll make sure we have the best budget we can,” Avalos added, noting that he plans to talk to labor and community based organizations about ways to increase city revenues. “But it’s hard, given that we need a two-thirds majority to pass stuff on the ballot,” he said.

Last year, Avalos helped put two measures on the ballot to increase revenues. Prop. J sought to close loopholes in the city’s current hotel tax, and asked visitors to pay a slightly higher hotel tax (about $3 a night) for three years. Prop. N, the real property transfer tax, h slightly increased the tax charged by the city on the sale of property worth more than $5 million.

Prop. J secured only 45.5 percent of the vote, thereby failing to win the necessary two-thirds majority. But it fared better than Prop. K, the competing hotel tax that Newsom put on the ballot at the behest of large hotel corporations and that only won 38.5 percent of the vote. Prop. K also sought to close loopholes in the hotel tax, but didn’t include a tax increase, meaning it would have contributed millions less than Prop. J.

But Prop. N did pass. “And that should raise $45 million,” Avalos said. “So, I’ve always had my sights set on raising revenue, but making cuts is inevitable.”

Will the “real” progressives please stand up?

Before Ed Lee was unanimously appointed interim mayor at the Jan. 11 Board of Supervisors meeting, Sup. David Campos delivered a speech about the progressive movement in San Francisco.

“Progressives are no longer in control of this Board of Supervisors,” Campos noted. “We have a president of the Board of Supervisors who was elected without a clear progressive majority, and who was elected with a clear backing of the moderate block of supervisors.”

Speaking to the notion that supervisors were not elected to take positions, but to get things done, an idea aired by Board President David Chiu, Campos demurred. “I don’t think it’s entirely accurate to say that none of us are elected to take certain positions,” he said.

“It’s important to get things done,” Campos continued. “But I don’t think getting things done is enough. We have to ask ourselves, what is it that we’re getting done? How is it that we’re getting things done? And for whom is it that we’re doing what we’re doing?”

Would things be done in the interests of the people, Campos wanted to know, “or the downtown corporate interests?”

Would things be done in a transparent way? “I hope we’re not getting things done behind closed doors,” Campos said.

Campos also took issue with the implication that “progressives cannot get things done.” He pointed to district elections, universal healthcare, domestic partner benefits, and police reform as accomplishments of the progressive community.

Despite Campos’ pronouncement that progressives were on the losing end, nearly every elected official who stood to speak throughout the course of the historic day uttered the P-word — including Lee himself.

“I was a progressive,” Lee said during his inaugural speech, “before progressive was a political faction in this town.” Lee pointed to his history of fighting for the rights of African Americans and Latinos, his move to establish a whistle-blower program, and his role in creating a recycling program for the city as evidence of his progressive credentials.

Supervisors Eric Mar, Ross Mirkarimi, and Chiu also touched on the issue of progressive politics in comments delivered before Lee was unanimously appointed. “Progressive politics needs to qualify its new definition,” Mirkarimi said, “which is more than just who we are by name or

by ethnicity or culture but by what we stand for.” Mirkarimi also spoke about the transition representing an opportunity to “inject a level of smart politics, not necessarily branded as a progressive or moderate or conservative, but smart politics that take us forward.”

Mar spoke about “our changing progressive movement,” and Board President David Chiu countered Campos’ charge that progressives had lost their control of the board, saying, “I do believe that the majority of this board shares progressive values.”

Chiu also said he believed that there is “a danger in an overly narrow definition of what is progressive.”

At this point, given so many different opinions and affiliations with the label, the very word “progressive” is starting to take on a confusing quality. Does this stem from a lack of a better term? Is it simply that many people with different sets of alliances and perspectives, sometimes at odds with one another, nonetheless identify as “progressives?”

Or is does this new, more complex version of “progressive” relate to the void left behind by two polarizing figures, who drew definitive battle lines between “progressives” and “moderates” by staking out furious opposition to each other? The transition of power in City Hall was marked not only by the introduction of new elected officials in the board chambers and Room 200, but by the departure of former Sup. Chris Daly and former Mayor Gavin Newsom, both towering white men known for relishing the limelight, delivering long-winded addresses, and waging fierce battles against their enemies.

If those elected officials once viewed as the solidly progressive block – former Sup. Chris Daly and Sups. John Avalos, David Campos, Eric Mar, and Ross Mirkarimi – were swept out of power with this shift, as Campos suggested, their political label seems to have survived intact. Despite the approving nod of the board’s moderates and two business-friendly powerhouses who hold tremendous sway even if they don’t hold office, the city’s top two officials — Chiu and Lee — nonetheless seemed eager to be associated with “progressive” values.

Chris Daly’s Final Say

As part of my effort to compile a list of most roastable moments of Sup. Chris Daly‘s decade-long career at City Hall, I asked the termed-out D6 supervisor if he would sit down for an exit interview. And shortly before Christmas, when there was still hope the Board would select a progressive interim mayor, and Daly had not yet vowed to politically haunt Board President David Chiu with shouts of, “It’s on like Donkey Kong” , we arranged to meet me at the Buck Tavern on Market Street, which Daly, who now holds the liquor license, is threatening to rename “Daly’s Dive.”

As it happens, the lion’s share of our conversation ended up taking place by cell, since Daly got stuck in late afternoon commuter traffic, as he drove to San Francisco from Fairfield, where his wife and children have lived since April 2009, making him a fitting symbol of the East-Bay-and-beyond migration pattern of couples who live in San Francisco, until they have more than one kid.

Except not all couples with two small kids get to move into one of two foreclosed properties that the in-laws bought with $545,000 cash in spring 2009. At the time, Daly’s critics accused him making such a mess of governing the city that he had decided against raising his own family here. Daly predictably disagreed. “There are few people who think about the future of San Francisco and the health of the city more than me,” Daly told reporters, explaining that his wife wanted family support raising their children, so she had moved to the same cul-de-sac as her parents, as Daly continued to live in a condo in San Francisco with roommates and to see his family on weekends.

Anyways, on the dark and stormy night that I interviewed Daly in mid-December, he acknowledged that he was going to be in for one helluva roast at the Independent on Jan. 5. in the worst possible sense of the tradition.
“Will there be controversial subjects, things that on the face of it, are not very nice? Yes,” Daly said.

And then he claimed he had agreed to this ordeal, because, under the roast’s traditional format , he would get to go last—and thus would get to have the last word.
“Why would I want to end my City Hall career like this? Because I get to go last, and can really say what’s on my mind,” Daly said. “Unless the D.J. wants to say something as he’s spinning.”

Daly’s comment suggests that folks who attend his roast at the Independent will witness a historically vicious verbal drubbing on all sides, since no one has ever accused Daly of holding back from saying what was on his mind. Even if it has led to seemingly counterproductive “We are shocked, SHOCKED!” responses. Like the time Sup. Michela Alioto Pier introduced an ultimately doomed etiquette ordinance, after Daly swore at a constituent during a City Hall meeting, in 2004.

Daly said at the time that he comes from a background as a housing-rights organizer on the streets of Philadelphia and San Francisco, where confrontation was an effective political tool. But he also claimed that he had learned an important lesson.
“In the future it’s going to be better for me personally and politically to focus my energy positively on the people I care about instead of negatively on the people I think are doing them harm,” Daly reportedly said.

Fast forward six years, and Daly is unrepentant about his record of fighting for low-income people, while openly defying City Hall’s unwritten rules of etiquette.
“Etiquette always seemed a little silly, something for the ‘other’ San Francisco, for the prim and the proper and that’s not what I am concerned about,” Daly said. “I’m aware of the turn-the-other-check philosophy, and, if I were religious, I’d be out of the Old Testament. I’d be, if someone pokes you in the eye, I’d poke back.”

Daly says he stopped caring about etiquette towards the end of his first year in office. “When those in power use that power to put down those who are less advantaged, when I see that, I respond quickly and with as much force as I can to prevent them from doing that kind of thing again,” he said. “ If you want to attack homeless people for political advantage, I’m going to attack you right back. That’s not ‘proper,’ but I think it’s just.”

Daly says he also soon realized tthat the truth wasn’t the driver.
“I already knew that money, power and significant forces would be pushing back against me but then I discovered that the actual truth wasn’t what played out there in the world of spin. It’s like when the Examiner’s Josh Sabatini asked me how I want to be remembered, and I said, “Not as the caricature the Examiner created of me.”

Daly, who moved to San Francisco in 1993 to work on homeless and affordable housing issues, was at the heart of the movement around Ammiano’s 1999 write-in campaign for mayor, and part of the progressive sweep onto the Board, in 2000.

“For me, it’s never been about being a ‘good’ vote. I breathe leftist progressive politics,” Daly said. “Where I can make more of a mark is in terms of setting the stage for those votes and holding the line in districts that are not progressive. I’m very proud of my attempts to hold the line on issues, but the work doesn’t make any friends.”

Daly noted that after he made comments about Newsom’s alleged cocaine use during the 2007 Mayor’s race, downtown interests threw everything they had left at him.
‘They got a lot of hits in, but no total blows,” he opines. “Last time I checked, I saved the city $150 million on the Americas Cup deal that they were going to ram rod through.”

And so, as he prepares to begin life as a bar owner, don’t expect Daly to pass up opportunities to launch verbal attacks, if he believes they are warranted, political consequences be damned.

“People want to have the power without any of the negativity they associate with all the shit we have to deal with to build this power,” Daly added. “So, it’s all, Daly and [former Board President Aaron] Peskin took control of the Democratic Party at midnight. Well, how did you want us to take over? “

Daly claims if you take away “negatives” attributed to him, you take away his wins. “People call me a lot of things, but I’m not a loser, I win a lot” Daly added, noting that Democrats being nice to Republicans has led to losses in D.C., not gains. “So, yes, I’ve got a lot of negatives, and they’ve clearly been made into a target, but if I can take the hits, and help people I care about, I’m happy to do it. That’s what I’ve done for ten years.”

Daly says he’s become “pretty desensitized to criticism,” even as he admits to being a sensitive person, deep inside. “I don’t think I’d have quite the visceral response to poverty and oppression, if I wasn’t sensitive,” he said. “I care deeply about people’s struggles. That’s why I’m here, but I also have a pretty solid critique of capitalism and I know how to follow the money, so when I get criticized by some downtown mouthpiece, I know what time it is.”

Daly says he started the Daly Blog several years ago, to push back against what he felt was unfair treatment in the media. And he says he endorsed outgoing mayor Newsom for Lt. Governor, despite their long and antagonistic history, so progressives could have a shot at installing a mayor in Room 200.

“My money now is on the selection of the mayor going to the new Board, and Avalos getting it in the 13th round of voting,” Daly said.

Daly made that prediction three weeks before the progressives on the Board seem poised to hand the keys to R.200 to City Administrator Ed Lee—thereby eliciting Daly’s ballistic “Donkey Kong” outburst.

With the outgoing Board set to meet Friday to make a selection, here’s another Daly roastable moment, this time from Peskin, related to the fall-out that ensued after Daly made two appointments to the SFPUC, while serving as acting mayor for one day, while then Mayor Willie Brown was out of the country, on a trip to Tibet.

“When Mayor Willie Brown left office, Charlotte Schultz had an unveiling ceremony of Brown’s picture. Newsom, who by then was mayor, was presiding. And Charlotte had a beautiful easel with a golden drape over it. When she pulled back the curtain there was a picture of Daly, who was listed as “41st and a half” mayor presiding from 9 a.m. to 2 p.m. on October 22,” Peskin recalled, noting that under Daly’s picture there was another curtain that contained Brown’s actual portrait.”

And while Daly’s controversial statements and outbursts always make headlines, there is no denying that he helped make the progressive agenda, including establishing mandatory paid sick days, universal healthcare, and forcing developers to contribute in affordable housing or services for poor, an integral part of city policy.
 “The Chronicle used him as the poster child to try and dissuade anyone from supporting a progressive agenda,” former Sup. Jake McGoldrick observed. “He was used to smear any of our good ideas. And Chris never seemed to understand that some of us needed to be a little more sensitive, since we needed to get re-elected and didn’t represent districts that were as progressive as his. Personal attacks make the whole situation smell bad.”

Sup. John Avalos, who served as Daly’s legislative aide until he was elected as D11 supervisor, acknowledged that a lot of folks have accused Daly of doing irreparable harm to the progressive movement and being a gift to Newsom and the moderates at City Hall.
“People try and make hay out of it,” he said. “But his antics have probably hurt him more than anyone,” Avalos added, noting that he ran in 2008 as Daly’s former legislative aide.
‘And it didn’t hurt me, and I made no bones about where I came from.”

And then there’s the fact Daly defeated the Chamber ’s Rob Black in the 2006 election. “We don’t do enough to have better relationships between ourselves,” Avalos added , reflecting on the divided progressive movement. “It’s more than just one person.”
 
Peskin for his part acknowledges that Daly will be missed on the Board.
 “He sucked the oxygen out of the room and made it all super lefty and caustic, and it certainly did not allow a better conversation to evolve,” Peskin said. “But it’s still going to be a pretty profound loss.”

Elizabeth Edwards, breast cancer and the battle for a cure

When the news hit that Elizabeth Edwards had died at 61, I was sitting in the press box at San Francisco City Hall listening to the supervisors debate the merits of local hire legislation. In fact, I only became aware that Edwards had passed away, because Sup. Michela Alioto-Pier, who was sitting in front of me, was surfing the Internet on her laptop and I happened to see the headline.

The news immediately reminded me, all too powerfully, of the brave fight that my sister-in-law Leila, 47, lost last year after a six-year battle with the disease. She left behind a husband and two young sons, and I always feel a mix of pride at how hard she fought and desperation at how she still wasn’t able to win, whenever I remember her long slide towards death last fall.

“I have so much to live for,” Leila often told me, reflecting on how much she loved her husband and sons, how she wanted to finish her novel (which she managed to wrap up in the last months of her life) and how she still wanted to visit so many places and people in the world.

An avid advocate for peace, especially in the Middle East, where her father’s family came from, Leila was not one to give up on a cause, once she had it in her crosshairs. She attacked breast cancer with that same dogged determination. She read everything she could on the topic, changing her diet, modifying her lifestyle, going through chemo and the inevitable loss of her beautiful hair, and, at the end, taking a chance with experimental drugs.

I will never forget her telling me, one gut-wrenching afternoon last September, that the doctors had told her there was nothing more they could do. The disease had gone to her liver, and that she was beginning to feel panic and fear. It wasn’t easy to hear that admission, it must have been even harder for her to share it, and it left me hoping that one day, no other woman would ever have to go through this painful battle again.

I wanted Leila to live to see her sons grow up, to enjoy the company of her husband, to write, travel and work for her goal of world peace. But eventually, it became clear that she was not going to make it. When her death finally came, last October, I felt relief that she was no longer suffering, even as I shed tears for her, her family, and all the folks in the world who are going through similar battles.

So, when I got home last night, I immediately went online and wallowed in the huge wave of grief that Edwards’ death evoked as a symbol of the millions of women who live with and die from cancer worldwide.

Some noted that Edwards had not been conducting regular check ups when she found a lump in her breast (an uncomfortable reminder to all of us who haven’t got a check up recently). Others observed that her diagnosis likely fueled her passion for universal health care and helped the passage of Obamacare (a more welcome reminder that despite all the criticisms of Obama, he has pushed through monumental reforms that many will benefit from).

Some wrote about the ever-present fear for survivors that the cancer could come back, and how this awareness had  served to make them more fully appreciate every moment that they do have. Others pointed to the grim reality that even with access to great doctors, advanced treatment options and money, Edwards still could not prevail, because a cure has still not been found.

I’ll end this tribute to Edwards, my sister-in-law, and all the women who have struggled with this terrible disease with a message that landed in my inbox Dec. 7 from California’s First Lady Maria Shriver:

“I was deeply saddened to learn of the passing of my dear friend, Elizabeth Edwards,” Shriver wrote. “My heart goes out to her loving family. Elizabeth was a mighty warrior, and I’ve long admired her courage, her compassion and her personal quest for truth. She was a public servant, a dedicated mother, a tireless advocate and a loyal friend. She showed up to speak at The Women’s Conference every time I asked, and our audience was always moved by the open and honest way she would share the struggles she faced along her journey. I hope her children know their mother was an inspiration to women everywhere — a truly great woman.”

And I’ll add my hope that this nation will intensify its search for a cure for a disease that is the second leading cause of cancer deaths in women today (after lung cancer) and the most common cancer among women, excluding nonmelanoma skin cancers. According to the American Cancer Society, 1.3 million women will be diagnosed with breast cancer annually worldwide, 465,000 will die from the disease, and about 1 in 35 women die from breast cancer in the U.S. Scary? Yes. Curable? Hell, yeah (I hope and pray). Let’s just make sure it remains a national priority.

WikiLeaks: demystifying diplomacy

OPINION Compared to the kind of secret cables that WikiLeaks just shared with the world, everyday public statements from government officials are exercises in make-believe.

In a democracy, people have a right to know what their government is actually doing. In a pseudo-democracy, a bunch of fairy tales from high places will do the trick.

Diplomatic facades routinely masquerade as realities. But sometimes the mask slips — for all the world to see — and that’s what just happened with the humongous leak of State Department cables.

“Every government is run by liars,” independent journalist I.F. Stone observed, “and nothing they say should be believed.” The extent and gravity of the lying varies from one government to another — but no pronouncements from world capitals should be taken on faith.

By its own account, the U.S. government has been at war for more than nine years now and there’s no end in sight. Like the Pentagon, the State Department is serving the overall priorities of the warfare state. The nation’s military and diplomacy are moving parts of the same vast war machinery.

Such a contraption requires a muscular bodyguard of partial truths, deceptions, and outright lies. With the nation’s ongoing war efforts at full throttle, the contradictions between public rationales and hidden goals — or between lofty rhetoric and grisly human consequences — cannot stand the light of day.

Details of Washington’s transactional alliances with murderous dictators, corrupt tyrants, warlords, and drug traffickers are among its most closely guarded quasi-secrets. Most media accounts can be blown off by officialdom, but smoking-gun diplomatic cables are harder to ignore.

With its massive and unending reliance on military force — with a result of more and more carnage, leaving behind immense grief and rage in Afghanistan, Pakistan, and elsewhere — the U.S. government has colossal gaps to bridge between its public relations storylines and its war-making realities.

The same government that devotes tremendous resources to inflicting military violence abroad must tout its humane bona fides and laudable priorities to the folks back home. But that essential public relations task becomes more difficult when official documents to the contrary keep leaking.

No government wants to face documentation of actual policies, goals, and priorities that directly contradict its public claims of virtue. In societies with democratic freedoms, the governments that have the most to fear from such disclosures are the ones that have been doing the most lying to their own people.

The recent mega-leaks are especially jarring because of the extreme contrasts between the U.S. government’s public pretenses and real-life actions. But the standard official response is to blame the leaking messengers.

What kind of “national security” can be built on duplicity from a government that is discredited and refuted by its own documents?

A complex and controversial project that would involve five San Francisco hospitals — including building a huge showcase facility for the wealthy atop Cathedral Hill — has prompted a debate about what average city residents need from the health care system.

California Pacific Medical Center, an affiliate of Sutter Health, proposes to downsize St. Luke’s Hospital, which primarily serves a low-income population in the Mission District, as part of a $2.5 billion proposal to renovate and retrofit three existing medical campuses, close another one, and build housing and a megahospital on Cathedral Hill that would draw patients from around the country.

CPMC’s grandiose plan was being considered strictly as a land use decision, despite its far-reaching impact on the city’s health care system. So Sup. David Campos created legislation calling for the city to create a citywide health services master plan and to use that as another tool for gauging future medical projects.

Debate over that legislation left some activists on both sides unhappy, with progressives disappointed that it won’t be able to stop a CPMC project they see as neglectful of the poor, and moderates wary of creating a new way to challenge development projects in the face of widespread unemployment in the construction industry.

But it struck a fine enough balance to win 8-3 approval by the board Nov. 16, enough to override a threatened mayoral veto. “I’m really happy and excited about the passage of this legislation,” Campos told the Guardian after the vote.

The legislation has a two-part mandate, with the first part kicking in as soon as it has final approval. It requires the Planning Department, with input from the Department of Public Health, to prepare a health care services master plan to identify current and projected needs for health care services and where they should be provided.

The second part, which begins in 2013, requires Planning to determine whether medical projects are consistent with the findings of this plan. That delay is credited to a last-minute amendment Campos granted during a Nov. 15 committee hearing after the hospital industry complained that the process could jeopardize its ability to meet state-mandated seismic retrofitting deadlines for projects already in the planning pipeline.

The passage of Campos’ legislation comes eight months after President Barack Obama signed the Patient Protection and Affordable Care Act. Hailed by its supporters as the most significant change to the U.S. health care delivery systems in 40 years, the reform package has also been greeted with criticism on both ends of the political spectrum. Progressives complain that it relies too heavily on private insurance companies and medical providers, while Tea Party supporters says that it’s government run amok and they have vowed to “kill the bill.” Senate Minority Leader Mitch McConnell (R-Ky) recently compared so-called Obamacare to “tyranny” in a speech to conservative legal scholars.

But here in San Francisco, the debate over Campos’ legislation — as heated and divisive as it was at times — yielded a surprising amount of consensus around the long-neglected idea that government should play a role in health care planning.

 

PULLING THE PLUG

The passage of Campos’ legislation marks the first time in 30 years that a government entity has mandated health care services planning in California. That approach West Bay Health Systems Agency, whose creation he opposed as governor of California.

Lucy Johns, a San Francisco-based health care planning consultant who wrote the only health care services master plan California has ever had, recalls what happened in the mid-1970s after President Gerald Ford signed legislation that established health system agencies nationwide.

“California established 14 health systems agencies, including the West Bay Health System Agency, which governed the nine Bay Area counties,” Johns told the Guardian. “The legislation mandated that they be established by every state, with the federal government providing the funding. So every state had to decide how many, how big, and how structured the health system agencies would be.”

Johns notes that state legislators were constrained when it came to the decisions these health service agencies made. “The governing bodies of the health systems agencies had to have a membership that was 51 percent consumer and 49 percent healthcare provider, which included doctors, nurses, and hospital administrators,” she said.

That history served as a backdrop for discussion of the Campos legislation, with the Planning Department staff report noting, “With the elimination of the West Bay Health Systems Agency in 1981, there is no longer a routine or comprehensive analysis of health service resources, needs, trends, and local impacts conducted for changes to or within medical uses.”

“It’s truly a historic moment for San Francisco,” Campos said after his legislation passed its Nov. 16 first reading (the second and final reading is set for Nov. 23, after Guardian press time). “We are the first city in the country to make sure land use decisions are aligned to our health care needs. That’s an unprecedented step that will shape the future of healthcare planning for years to come.”

Campos acknowledged that the passage of Obama’s heath reform package — which includes a mandate to purchase private health insurance beginning in 2014 — was also a catalyst for his legislation, along with the CPMC project.

“But it had more to do with seeing that the city didn’t have the tools it needed to evaluate projects in terms of whether they met the city’s healthcare needs and how they might impact people’s access to healthcare,” Campos said. “The main catalyst came from the community, which felt it was being asked to make decisions that will have long-lasting health care implications, but didn’t have any way to understand those needs. Those concerns were compounded by changes at the national level — and the recognition that these changes offer us an opportunity to engage in planning.”

Campos’ legislative victory came two months after members of the Cathedral Hill Neighbors Association joined nurses, medical workers, patients, and community groups in voicing concerns at a Sept. 23 public hearing about the draft environmental impact report for CPMC’s Cathedral Hill hospital and the other facilities that are part of its proposal.

These groups collectively expressed fear that downsizing St. Luke’s, closing the CPMC California campus, and transforming CPMC Pacific campus to an outpatient-only hospital will force low-income people to travel farther to access health care services while offering better service to the wealthy at Cathedral Hill. And neighbors worried that the proposed complex would increase traffic and require the demolition of rent-controlled apartments.

Formed in 1991 through the merger of Pacific-Presbyterian Medical Center and Children’s Hospital of San Francisco, CPMC has been affiliated with Sutter Health since 1996 and currently has four medical campuses in San Francisco: Pacific in Pacific Heights, California in Presidio Heights, Davies in the Duboce Triangle, and St. Luke’s in the Mission.

But CPMC’s longtime goal was to build a facility intended to be like the Mayo Clinic of the West Coast, a 15-story, 555-bed full-service hospital and specialty care facility at the corner of Van Ness Avenue and Geary Boulevard. Company officials have made approval for that project conditional on keeping St. Luke’s open in the face of the state’s deadline on seismic safety standards that the hospital doesn’t now meet.

“St. Luke’s Hospital was the big issue that got our attention,” Le Tim Ly, lead organizer for the Chinese Progressive Association, told the Guardian. His group has worked with residents in the city’s southeast sector around environmental justice, air quality, and pollution issues when they became aware of the threat to St. Luke’s. “All this, coupled with efforts to downsize Luke’s, left us alarmed by the disproportionate impact on an already impacted area.”

But alarm over CPMC’s plans has now revived the idea of healthcare planning.

 

MAKING A PLAN

As recently as the beginning of November, representatives for the Hospital Council of Northern and Central California — whose members include CPMC, Chinese Hospital, Jewish Home, Kaiser Permanente, Laguna Honda, St Luke’s, St. Mary’s, San Francisco General Hospital, and Veterans Affairs Medical Center — seemed opposed to any change in the way healthcare planning is done in San Francisco.

At a Nov. 1 hearing on the Campos legislation at the board’s Land Use and Economic Development Committee, Ron Smith, the Hospital Council’s senior vice president for advocacy, said his organization favored maintaining the city’s current procedures. “We would like to propose that the Health Commission does the planning, the Planning Commission does the land use, and that there is a required determination process which is in the current legislation,” Smith said. “We’re proposing that that continue.”

But two weeks later, after Campos amended his legislation so projects now in the planning pipeline are exempt from having to comply with the city’s health care services master plan, some members of the Hospital Council seemed to have a change of heart.

CPMC’s Chief Executive Officer Warren Browner surprised just about everybody when he publicly stated in mid-November that CPMC supports health care planning. “We strongly support the efforts of the city — we are in favor of health planning,” Browner said at a Nov. 15 hearing on the legislation.

“That statement was extraordinary,” said Lucy Johns, recalling CPMC’s history of resisting government control. “The conversation about this legislation has already changed the discourse, at least in public.”

Linda Schumacher, chief executive officer of Chinese Hospital, a community-owned, not-for-profit facility, explained at the same hearing that her organization had been concerned that Campos’ legislation would affect her hospital’s ability to move ahead with a $150 million project that has been in the pipeline since 2003.

“We thank you for that amendment that allows the effective date to be changed,” she said.

“It shows how much progress had been made, even before this legislation goes into effect,” Campos said of the hospital industry’s apparent shift in attitude. “It’s a monumental step, something that was not expected as recently as a few months ago.”

But Ly of the Chinese Progressive Association said he believes the Hospital Council still doesn’t want to see the city getting involved. “As recently as a month ago, their folks were speaking out against any kind of legislation. But I think they started seeing the writing on the wall.”

Ly fretted about the potential negative impact of Campos’ last-minute amendments. Sup. Campos’ plan represents a victory. But we could use that information as soon as possible. The 2013 deadline means the city will be handicapped: it will have information it can’t use yet.”

Ly ventures that the hospital industry’s approach will be to try to lessen the impact of the legislation. “As written, it still provides the Planning Commission and the board with the discretion to approve projects,” Ly said. “Ultimately, the struggle is about values. Just because there are plans and guidance doesn’t mean the healthcare needs of the community will become a top priority — it just provides us with tools to make an assessment.”

Campos counters that his bill will allow the city to create incentives for, and apply pressure on, the hospital industry. “If they truly want their projects to be expedited and approved before state-mandated seismic retrofitting deadlines kick in, they’ll propose plans that work for the community,” Campos explained.

But even as it publicly vows to be supportive, the Hospital Council continues to express concerns about the Campos legislation. “It’s the council’s job is to be supportive now that the board has approved Campos’ plan,” Smith said. “And Sup. Campos was very generous. He started talking to us in June. But we really didn’t get a handle on his proposal until much later. We think the idea of healthcare planning is very good. We still have concerns about the process, but now the board has voted on the legislation, our goal is to do our best to work with the law.”

Concerns that the legislation would be used to mire projects in repeated appeals and give too much weight to critics’ concerns was raised at the Nov. 16 hearing by Sup. Sean Elsbernd.

“Right now, if anyone has concerns, there’s a conditional use process and a CEQA [California Environmental Quality Act] process,” Elsbernd told the Guardian. “But this turns up a brand new appeal. It means the appeals are heard at the same time, but you’ve now created a third route.”

Campos responded to these concerns by amending the legislation to clarify that the board must act on consistency determination appeals at the same time it acts on other related appeals, so projects won’t be delayed.

Evidently this wasn’t enough to appease the San Francisco Chamber of Commerce. “We cannot be supportive of that piece of legislation,” Rob Black, the Chamber’s vice president of public policy, told the Guardian after the legislation was approved. “We believe appeals should be done at the Department of Public Health in conjunction with service providers, since San Francisco provides 20 percent of service, and private organizations provide the remaining 80 percent.”

Black says the Chamber was pleased Campos amended his legislation so as not to slow down projects that are currently in the planning pipeline. But he claimed Campos’ legislation could actually limit access to healthcare services. “The Chamber is concerned that Campos’ legislation will make it harder for doctors to pool together in pods, and if we don’t do that, it won’t make healthcare more available because services will be more expensive,” Black said. “But we absolutely think” the city should analyze gaps in providing health care to San Franciscans.

Campos’ aide Hillary Ronen confirmed that Black is correct in saying that anyone can appeal a hospital project’s consistency determination. “But the final analysis will revolve around asking if the proposed project meets the health care needs of San Francisco,” she said. “If it doesn’t, and the board doesn’t believe there’s a compelling public policy reason to approve the project, [the board] can override the approval.”

 

PATIENTS VS. PROFITS

Mary Michelucci, a registered nurse for 40 years and a member of the California Nurses Association, is hopeful that Campos’ legislation will rein in the hospital industry.

“I hope that any plan that would favor patient care over profit would be the way to go,” Michelucci said. “Running a hospital is expensive. But with the profits that Sutter and CPMC are making, they can afford this.”

Michelucci says the dispute over St. Luke’s came to a head three years ago, when nurses began to suspect that CPMC was planning to let the facility fail, suspicions that intensified when CPMC closed St. Luke’s neonatal intensive care unit 18 months ago.

“Now the babies who need neonatal special care are transported to CPMC’s California campus, which is in the Richmond,” Michelucci said. “But the moms may be discharged and most of them live in the Mission or Bayview-Hunters Point.”

Michelucchi still fears that CPMC will wage “a horrific campaign” against the California’s Nurses Association as it continues to push the plan for its megahospital. “CPMC wants to be in complete control of the registered nurses,” she said. “We, unfortunately, are their conscience, while they are a business model in the business of healthcare. The decisions they make about healthcare are not in the interests of patients or nurses, and we are the thorn in their side.”

All this is happening against the backdrop of the worst economic recession since the Great Depression, and for construction workers facing high unemployment rates in San Francisco, CPMC’s megaproject clearly represents light at the end of a very dark tunnel.

“CPMC is my future,” William Hestor, a 28-year-old father of two and member of SEIU-United Healthcare Workers, said at the Nov. 15 hearing. “We worked hard on a contract and we just want to make sure our hospital is built on time.”

CPMC media spokesperson Kevin McCormack told the Guardian that the real issue between CPMC and the CNA is union membership at CPMC’s Cathedral Hill facility. “CPMC is reducing beds at St. Luke’s because the beds aren’t in use, but the facility will be able to take care of 90 percent of patients’ needs and if you need specialist care, a shuttle will take you to Cathedral Hill,” McCormack said. “This centralized arrangement is the best way to attract the best staff and equipment.”

McCormack noted that there are union members and 1,200 nonunion nurses working at CPMC facilities in San Francisco. “We are bringing together nonunion and union nurses together at this facility, and we don’t feel we have the right to force our nonunion nurses to join,” he said, adding that since the Teamsters, the Carpenters, and SEIU-United Healthcare Workers (UHW) are already unionized at the Pacific and California campuses, they’ll be allowed to unionize at Cathedral Hill.

CNA member Eileen Prendiville, who has worked in San Francisco as a registered nurse for decades, recalls the negative changes she has already seen at CPMC’s facilities, including eliminating registered nurses and specialty services.

“If you pull services, as they have, of course you’ll have fewer patients. And the physicians start leaving, so it’s a vicious cycle,” she said. “St. Luke’s was a small community hospital but now it’s all about corporate medicine.”

Sup. Eric Mar sided with those seeking to exempt current projects from the city’s health care services master plan. But Sup. Sophie Maxwell noted that the Planning Commission will take a facility’s historical role into account in determining whether projects are consistent with the city’s health care services plan.

“We believe that addressed community concerns,” Maxwell said. “St. Luke’s would never have been targeted for closure had this legislation been on the books in the past.”

Campos insists his legislation is not simply about CPMC. “Ultimately this legislation stems from a number of pleas we have heard in the last couple of years from people throughout the city,” he said. “It takes the institutional master planning process to the next level. We have tried to consolidate the appeal process under existing law. Important as the legislation is, it’s key to make sure we have the right master plan because that’s where the heavy lifting will take place.”

Meanwhile, the final EIR is being completed for the CPMC project, which should go before the Board of Supervisors for approval early next year.

Only a miracle can save Steve Li now

Supporters of Shing Ma “Steve” Li, a 20-year-old nursing student, gathered outside the offices of Sen. Barbara Boxer today to urge her to sponsor a private bill in a last ditch effort to halt Li’s deportation to Peru, which is scheduled to take place Monday, November 15—two months after ICE (Immigration and Customs Enforcement) agents arrested Li in San Francisco.

“While we do not introduce private bills, our staff is happy to meet with Mr. Li’s family and his attorneys to discuss his case,” Boxer spokesperson Zachary Coile emailed the Guardian, as protesters delivered stack of letters to Boxer’s office, asking that she intervene in Li’s case.

Unlike Sen. Dianne Feinstein who has sponsored private bills in the past, Boxer has no record of intervening in this way. But advocates were hopeful that now that she has survived the November 2010 election, Boxer will pull off a miracle before Monday.

This afternoon, Li’s attorney Sin Yen Ling texted the Guardian that her request for deferred action had been denied, meaning that Li will be on a plane to Peru on Monday, baring some last minute miracle.

“Our office has been in touch with ICE and is exploring the options,” Gil Duran, media spokesperson for Sen. Dianne Feinstein told the Guardian, half an hour after Li’s request for deferred action was denied.

And Boxer spokesperson Zachary Coile said the senator’s staff met with Li’s mother, his attorney, his City College professor and others, this afternoon.

“While we do not introduce private bills, our staff was happy to meet with Steve Li’s family and his attorney to discuss his case,” Coile stated. “We reiterated Senator Boxer’s strong support for the DREAM Act, which would provide a path to citizenship for tens of thousands of undocumented students who go to college or serve in the military. Senator Boxer will keep working in the Senate until it becomes law.”

And tonight, Drew Hammill, press secretary to Speaker Nancy Pelosi emailed the following statement to the Guardian:

“Speaker Pelosi believes that Steve Li’s case is a textbook example of the pressing need for comprehensive immigration reform and passage of the DREAM Act. Speaker Pelosi is working with other Members to recommend that ICE grant deferred action in this case.”

Boxer, Feinstein and Pelosi, who have both been strong supporters of the DREAM Act, have vowed to keep working until it is passed.

Earlier this fall, on Sept. 14—the day before ICE arrested Li– Senate Majority Leader Harry Reid announced plans to add the DREAM Act as an amendment to the Department of Defense authorization bill.

But that effort was blocked by Senate Republicans. And after the bloodbath that congressional Democrats endured this November, it’s unclear if the DREAM Act has a prayer, though Nancy Pelosi vowed to move it forward during Congress’ upcoming lame-duck session, and it has continued to attract bi-partisan support since it was first introduced in 2001 by Senators Richard Durbin (D-Il) and Richard Lugar (R-IN).

At today’s protest, Li’s legal counsel, Sin Yen Ling, decried the federal government’s decision to deport her client.

“A 20-year-old City College student is not a threat to our national security,” Ling said. “We need to bring Steve Li home as soon as possible.”

According to Ling, Li has not seen his mother Maria, who divorced Li’s dad for years and lives with Li in San Francisco, since his Sept. 15 arrest, when  ICE picked up Li and his mother in Ingleside on Sept. 15 and placed them in separate cars. The car carrying Li then picked up Li’s  father in the Richmond, and all three family members were processed at ICE’s Sansome Street office in downtown San Francisco, before being transferred to Sacramento County Jail. But Li was then involuntarily transferred to an ICE detention facility in Arizona. Meanwhile, Li’s parents were released from detention when ICE determined that China does not want them back because they left China seeking political asylum. But they are now required to wear cumbersome electronic monitoring anklets, because they are deemed a flight risk, and are not allowed to leave San Francisco.

As a result, Li’s parents have been unable to visit their son in Arizona. And should he be deported to Peru, it’s not clear if they will be permitted to follow. And should if they decide to travel to Peru, they will not be allowed to reenter the U.S. for at least ten years, further complicating a complex situation.

At today’s rally, Li’s mother Maria spoke in public for the first time,  breaking down into tears, as she begged Sen. Boxer and the U.S. government to help.

“He has no money, no clean clothes, how will he get by?” she asked, referring to ICE’s plan to put her son on a plane to Lima, Peru, where he reportedly knows no one.  “Sen. Boxer, will you just watch and pretend you didn’t see anything? Today, when you see all of us standing here begging you, will you respond to us? I hope you can understand it from a mother’s perspective and meet with me to discuss how we can help Steve.”

Ling said Li’s mother decided to speak because of the direness of her son’s situation, even though she was wearing a federally-mandated monitoring anklet.
“She felt it was now or never,” Ling said.

Li’s teacher Sang Chi also spoke, praising Li as a model student and a prime example of the kind of person that should be eligible for the DREAM Act. And then the Rev. Norman Fang led Li’s supporters in a prayer.

‘We ask that a miracle take place and that Steve’s mom and San Francisco can be happy again, that the heart and soul of what is morally right can overcome regulations,” Fang said, noting that 100 years, his family members were detained at Angel Island “for no other reason than they were Chinese. ‘There is only one border in our world—the one that separates Heaven and Earth.”

Li’s attorney Sin Yen Ling clarified that she doesn’t believe that ICE singled Li out.
“He’s just been swept up as part of a larger program,” Ling said, noting that actions that split families apart and target folks who came to this country as undocumented children have inspired a movement of DREAMers—folks who support the DREAM Act.

Every year, about 65,000 U.S. raised students, who would qualify for the DREAM Act’s proposed benefits, graduate from high school, according to the National Immigration Law Center (NILC).

“These include honor roll students, star athletes, talented artists, homecoming queens, and aspiring teachers, doctors and U.S. soldiers,” states a NILC press release. “They are young people who have lived in the U.S. for most of their lives and desire only to call this country their home. Even though they were brought to the U.S. years ago as children, they face unique barriers to higher education, are unable to work legally in the U.S. and often live in constant fear of detection by immigration authorities.”

Asked how ICE caught up with Li, who does not have a criminal record, Ling pointed to modern technology
“In this day and age, you can track anyone down,” Ling said.” And it’s a priority for ICE to identify people with final deportation orders,” she continued. Ling was referring to the fact that Li’s parents were denied their request for political asylum from China and issued a removal order, unbeknownst to their son Steve, who was born in Peru, came to the U.S. when he was 12 and was 14, when his parents’ asylum request was denied.

But Ling did not blame President Barack Obama, who promised to bring millions of undocumented residents out of the shadows, when he was running for president in 2008.
“It’s tough to criticize the president when he had five different priorities coming into office, including healthcare. His administration probably miscalculated how long it would take to pass healthcare. And part of the problem is partisan politics around immigration.”

Ling estimates that there are two million young people currently in the U.S. who would benefit from the passage of the DREAM Act, but blamed partisan politics for why the legislation failed to pass by only 3 votes in the Senate in September.

Sup. David Campos showed up at the rally and told Li’s supporters that the Board of Supervisors unanimously approved a resolution Nov. 9 calling for ICE to defer Li’s deportation.

“The Board is not always on the same page, but on this issue we were unanimous,” Campos said. “We get it, we understand the tragedy that this deportation would result in. And we remain hopeful that something will happen. There are millions of young people in the same predicament, and the solution is not deportation. The solution is passing comprehensive immigration reform. Until then, we need an intervention.”

Meanwhile, somewhere in Arizona, Steve Li sits in a jail cell, hoping, praying and dreaming…

OPINION Now what?

Now we need to build a grassroots progressive movement — wide, deep, and strong enough to fight the right and challenge the corporate center of the Democratic Party.

The stakes are too high and crises too extreme to accept “moderate” accommodation to unending war, regressive taxation, massive unemployment, routine foreclosures, and environmental destruction.

A common formula to avoid is what the Rev. Martin Luther King Jr. called “the paralysis of analysis.” Profuse theory + scant practice = immobilization.

It’s not enough to denounce what’s wrong or to share visionary blueprints. Day in and out, we’ve got to organize for effective and drastic social change, in all walks of life and with a vast array of activism.

Yes, electioneering is just one kind of vital political activity. But government power is extremely important. By now we should have learned too much to succumb to the despairing claim that elections aren’t worth the bother.

Such a claim is false. For instance, consider the many hundreds of on-the-ground volunteers who rejected the paralysis of analysis by walking precincts and making phone calls to help reelect progressive Rep. Raul Grijalva (D-Arizona). Grijalva won a tight race in the state’s southwestern district and will return to Congress next year — much to the disappointment of the corporate flacks and xenophobes who tried to defeat him because of his strong stance against the state’s new racial-profiling immigration law.

The mass-media echo chamber now insists that Republicans have triumphed because President Obama was guilty of overreach. But since its first days, the administration has undermined itself — and the country — with tragic under-reach.

It’s all about priorities. The Obama presidency has given low priority to reducing unemployment, stopping home foreclosures, or following through with lofty pledges to make sure that Main Street recovers along with Wall Street.

Far from constraining the power of the Republican Party, the administration’s approach has fundamentally empowered it. The ostensibly shrewd political strategists in the White House have provided explosive fuel for right-wing “populism” while doing their best to tamp down progressive populism. Tweaks aside, the Obama presidency has aligned itself with the status quo — a formula for further social disintegration and political catastrophe.

The election of 2010 is now grim history. It’s time for progressives to go back to the grassroots and organize with renewed, deepened commitment to changing the direction of this country. If we believe that state power is crucial — and if we believe in government of, by, and for the people — it’s not too soon to begin planning and working for change that can make progressive victories possible in future elections.

The “Democratic Machine” myth

Okay, I read the gloating from Randy Shaw about Jane Kim defeating the “Democratic Party Machine,” which, as far as I can tell, seems to consist of the Democratic County Central Committee and the Bay Guardian. (As I’ve said before, if I were that powerful, things would change around this city ….)


It annoys me because machine politics were once a harsh reality in this town. But not these days.


Let’s look seriously at the supposed immense clout of the DCCC. Everyone from Shaw to The Chron’s C.W. Nevius has been freaking out over the ability of the local Democratic Party to control who gets elected to the Board of Supervisors. And while I think it’s a good idea to have prgoressives control the local party (this is, after all, San Francisco), even a cursory look at election results suggests that this vaunted machine isn’t really running much of anything.


In every contested race for supervisor — every single one — the candidate endorsed first by the DCCC appears headed for defeat. It’s not just D6; The DCCC endorsed DeWitt Lacy in D10, and he finished well out of the picture. The person leading that race today, Tony Kelly, wasn’t even in the DCCC’s top three. The panel backed Rafael Mandelman in D8; Scott Wiener won. The party gave its nod to Janet Reilly in D2, and if early RCV results hold, she’s in serious trouble.


Here’s the facts: With district elections, and a weak mayor, power is far too diffuse in San Francisco today for anyone to operate a political machine. District races this time around weren’t about the DCCC; they were about local campaigns organizing around local issues.


The DCCC helped Debra Walker somewhat in D6 , but it also hurt: In the end, Kim won with a campaign that painted Walker as an old-school machine party politician — and, interestingly enough, according to Paul Hogarth, she won by reaching out to the more conservative voters:


We focused on pitching her biography as a Stanford and Berkeley graduate, who is a civil rights attorney. And Jane Kim was the kind of young professional these voters could relate to. 


If Randy Shaw was right, and a powerful Democratic party machine ran city politics, we wouldn’t all be scratching our heads and wondering who the hell the next mayor will be. I can tell you right now: Aaron Peskin, the titular head of this mighty machine, is pretty far out of the running. Sup. David Chiu, who has pretty much cut ties with Peskin and worked to elect Kim, is one of the top mayoral contenders. It’s also entirely possible that Mark Leno — who is by no means part of any Peskin operation — will wind up in Room 200.


Labor — supposedly part of this machine, too — can’t even agree half the time on its own endorsements — witness the United Healthcare Workers local splitting dramatically with its Local 1021 brothers and sisters in SEIU. UHW backed Wiener, Theresa Sparks and Steve Moss — all candidates opposed by Local 1021.


It’s an unsettled time in local politics, and I hope that the progressives who care about issues, not personalities and silly labels, can come together and choose a mayor who will support a progressive agenda. But that will be a close call, and no doubt will involve a temporary coalition that will fall apart as soon as the deal is done.


Because right now, nobody’s calling the shots in local politics. Just look at the facts on the ground.

With the general election just days away, campaign disclosure reports show that downtown interests are spending huge amounts of money to create a more conservative San Francisco Board of Supervisors and to pass Proposition B, Public Defender Jeff Adachi’s effort to make city workers pay more for their pensions and health insurance.

Much of the spending is coming from sources hostile to programs designed to protect tenants in the city, including rent control and limits on the conversion on rental housing units to condominiums. An ideological flip of the board, which currently has a progressive majority, could also have big implications on who becomes the next mayor if Gavin Newsom wins his race for lieutenant governor.

At press time, downtown groups were far outspending their progressive counterparts through a series of independent expenditure committees, most of which are controlled by notorious local campaign attorney Jim Sutton (see “The political puppeteer,” 2/4/04) in support of supervisorial candidates Mark Farrell in District 2, Theresa Sparks in District 6, Scott Wiener in District 8, and Steve Moss in District 10.

Prop. B has also been a big recipient of downtown’s cash, although labor groups have pushed back strongly with their own spending to try to kill the measure, which is their main target in this election.

But the biggest spender in this election appears to be Thomas J. Coates, 56, a major investor in apartments and mobile homes and a demonstrated enemy of rent control. He alarmed progressive groups by giving at least $250,000 to groups that support Farrell, Sparks, Wiener, Moss, and Prop. G, legislation that Sup. Sean Elsbernd placed on the ballot to cut transit operator wages and change Muni work rules.

Although Coates declines to identify with a political party on his voter registration, he donated $2,000 to President George W. Bush in 2004. More significantly, he was the biggest individual donor in California’s November 2008 election, when he contributed $1 million to Prop. 98, which sought to repeal rent control in California and limit the government’s right to acquire private property by eminent domain.

Coates, who is also a yachting enthusiast and sits on San Francisco’s America’s Cup Organizing Committee (ACOC), donated $100,000 on Oct. 20 for Farrell, $45,000 for Sparks, $45,000 for Moss, and $10,000 for Wiener through third-party independent expenditure committees such as the Alliance for Jobs and Sustainable Growth.

The group has already received thousands of dollars in soft money from the San Francisco Police Officer’s Association, the Building Operators and Managers Association, the Golden Gate Restaurant Association, and SEIU-United Healthcare Workers, which supports a high-end hospital and housing complex on Cathedral Hill.

Those downtown groups have spent close to $200,000 on English and Chinese language mailers and robo calls in support of Sparks, Wiener, and Moss in hopes of securing a right-wing shift on the board.

Progressive groups including California Nurses Association, the San Francisco Tenants Union, and the SF Labor Council have tried to fight back in the supervisorial races. While downtown groups spent more than $100,000 promoting Sparks in D6, labor and progressive groups spent $13,000 opposing Sparks and $72,000 supporting progressive D6 candidate Debra Walker.

In D8, progressive groups that include teachers, nurses, and transit riders have outspent the downtown crowd, plunking down $40,000 to oppose Wiener and $90,000 to support progressive candidate Rafael Mandelman. So far, downtown groups have spent about $100,000 to support Wiener.

But in D10, the district with the biggest concentration of low-income families and communities of color, downtown interests spent $52,000 supporting Moss and $5,000 on Lynette Sweet while the Tenants Union was only able to summon $4,000 against Moss. The SF Building and Construction Trades Council spent $4,000 on Malia Cohen.

But that’s small potatoes compared to what downtown’s heavy-hitters are spending. The so-called Coalition for Sensible Government, which got a $100,000 donation from the San Francisco Association of Realtors, has already collectively spent $96,000 in support of Sparks, Wiener, Moss, Sweet, Rebecca Prozan in D8, Prop. G and Prop. L (sit-lie) and to oppose Prop. M (the progressive plan for police foot patrols) and Prop. N (a transfer tax on properties worth more than $5 million).

The Coalition for Responsible Growth, founded by Anthony Guilfoyle, the father of Mayor Gavin Newsom’s ex-wife, Kimberly Guilfoyle (who now works as a Fox News personality), has received $85,000 from the Committee on Jobs, $60,000 from the Realtors, and $35,000 from SF Forward. It has focused on spending in support of Prop. G and producing a voter guide for Plan C, the conservative group that supports Sparks, Wiener, Sweet, and Moss

Coates’ donations raise questions about his preferred slate’s views on tenant and landlord rights. A principal in Jackson Square Properties, which specializes in apartments and mobile homes, Coates is the founding partner of Arroya & Coates, a commercial real estate firm whose clients include Walgreens, Circuit City, and J.P. Morgan Investment Management. In 2008, when he backed Prop. 98, Coates told the San Francisco Chronicle that rent control “doesn’t work.”

Ted Gullicksen, director of the SF Tenants Union (SFTU), which has collectively spent $30,000 opposing Sparks, Wiener, and Moss, is disturbed that Coates spent so much in support of this trio.

“Coates was the main funder of Prop. 98,” Gullicksen explained. “His property is in Southern California. He’s pumping a lot of money into supervisors. And he clearly has an agenda that we fear Moss, Sparks, and Wiener share — which is to make the existence of rent control an issue they will take up in the future if elected to the board.”

That threat got progressive and labor groups to organize an Oct. 26 protest outside Coates’ San Francisco law office, with invitations to the event warning, “Be there or be evicted!”

Sparks, Moss, and Wiener all claim to support rent control, despite their support by someone who seeks to abolish it. “I answered such on my questionnaire to the SFTU, which chose to ignore it,” Sparks told the Guardian via text message. “In addition, I’ve been put out of apartments twice in SF, once due to the Ellis Act. They ignore that fact as well.”

Records show that in May 2009, Moss — who bought a rent-controlled apartment building near Dolores Park in D8 for $1.6 million and he lived there from the end of 2007 to the 2010, when he decided to run for office in D10 — served a “notice to quit or cure” on a tenant who complained about the noise from Moss’ apartment. Ultimately, Moss settled without actually evicting his tenant.

“I read about Coats’ [sic] contribution in Bay Citizen,” Moss wrote in an e-mail to the Guardian. “This donation was made to an independent expenditure committee over which I have no control and almost no knowledge. I have stated throughout the campaign, and directly to the Tenants Union, that I believe current rent control policy should remain unmolested.”

But Moss is with downtown on other key issues. He supports Newsom’s sit-lie legislation and the rabidly anti-tenant Small Property Owners Association, whose endorsement he previously called a “mistake.”

Yet Moss, who sold a condo on Potrero Hill in 2007 for the same price he paid for the entire building in 2001, seems to voice more sympathy for property owners than renters, who make up about two-thirds of city residents. He told us, “Landlords feel that they are responsible for maintaining costly older buildings and that they are not provided with ways to upgrade their units in ways that share costs with tenants.”

Another realm where downtown seems to be trying to flip the Board of Supervisors on a significant agenda item is on health care, particularly the California Pacific Medical Center proposal to build a high-end hospital and housing project on Cathedral Hill in exchange for rebuilding St. Luke’s Hospital in the Mission.

The project has divided local labor unions. UHW supports the project and a slate of candidates that its parent union, Service Employees International Union, is opposing through SEIU Local 1021, which is supporting more progressive candidates. The California Nurses Association also opposes the project and candidates such as Wiener who back it.

“A recent mailer by CNA falsely says that CPMC is closing St. Luke’s and Davies,” CPMC CEO Warren Browner recently complained in a letter to the Board of Supervisors. “We are not. We are committed to building a state-of-the-art, high-quality replacement hospital at St. Luke’s and continuing to upgrade Davies.”

But the CPMC rebuild is contingent on the board approving the Cathedral Hill project. So the CNA mailer focused on what could happen if the city rejects the CPMC project: “We could lose two San Francisco hospitals if Scott Wiener is elected supervisor.”

SEIU-UHW’s alliance with downtown groups and its use of member dues to attack progressive candidates places it at odds with SEIU Local 1021 and the SF Labor Council, which has endorsed Janet Reilly in D2, Walker in D6, Mandelman in D8, and Cohen (first choice) and Chris Jackson (second choice) in D10.

“We’re really disappointed that there are labor organizations that feel they have to team up with Golden Gate Restaurant Association, which is against health care [it challenged the city’s Healthy San Francisco program all the way to the U.S. Supreme Court], and with CPMC, which is working to keep nurses from joining a union,” Labor Council Director Tim Paulson said. “This alliance does not reflect what the San Francisco labor movement is about.”

Paulson said that the Labor Council values “sharing the wealth … So we don’t want Measure B [Jeff Adachi’s pension reform] or K [Newsom’s hotel tax loophole closure, which has a poison pill that would kill Prop. J, the hotel tax increase pushed by labor] or L [Newsom’s sit-lie legislation],” Paulson said.

CPMC’s plan is headed to the board in the next couple months, although Sup. David Campos is proposing that the city create a health services master plan that would determine what city residents actually need. Hospital projects would then be considered based on that health needs assessment, rather than making it simply a land use decision as it is now.

Moss told the Guardian that UHW endorsed him because of his positions on politicians and unions. “I agreed that politicians should get not involved in union politics,” Moss said. “The United Healthcare Workers seem to be a worthy group,” he added. “All they said was that they wanted to make sure that they had access.”

But CNA member Eileen Prendiville, who has been a registered nurse for 33 years, says she was horrified to see UHW members recently oppose Campos’ healthcare legislation. “I was shocked that they were siding with management,” she said.

Prendiville believes UHW is obliged to support CPMC’s Cathedral Hill plan, which is why it is meddling in local politics. In his letter to the board, Browner noted that his company and its parent company, Sutter Health, can’t legally do so directly. “The fact is that CPMC and Sutter Health are 501(c)(3) not-for-profit, nonpartisan organizations, and we neither endorse nor contribute to candidates,” Browner wrote.

“When UHW settled its contract with its members [as part of its fight with the rival National Union of Healthcare Workers], they had to publicly lobby for Cathedral Hill,” Prendiville claimed.

SEIU 1021 member Ed Kinchley, who works in the emergency room at SF General Hospital, is also furious that UHW is pouring money into downtown’s candidates and measures. “UHW isn’t participating in the Labor Council, it’s doing its own thing,” he said.

Kinchley said UHW, which is currently in trusteeship after a power struggle with its former elected leaders, is being controlled by SEIU’s national leaders, not its local membership, which explains why it’s aligned with downtown groups that have long been the enemy of labor.

“Sutter wants a monopoly on private healthcare and people like Rafael Mandelman and Debra Walker have been strong supporters of public healthcare,” Kinchley said. “I want someone who can straight-up say, here’s what’s important for families in San Francisco, especially something as important as healthcare. Republican who wants to overturn rent control pumps $200,000 into district elections

Thomas J, Coates, a big time investor in apartments and mobile homes, has dropped a total of $225,000 into five independent expenditure committees that are trying to push conservative-friendly candidates and measures over the victory line this fall.

Coates, a 56-year-old Republican (he donated $2,000 to George Bush in the 2004 presidential election) and yacht racing enthusiast, was the biggest single spender in the November 2008 election, when he contributed nearly $1 million to Prop. 98, a statewide measure that sought to repeal rent control in California and limit government’s right to seize private property by eminent domain.

And with only 11 days until the election, Coates has given local Republican war chests an enormous last-minute boost: He plunked $100,000 into Common Sense Voters, a committee in support of Mark Farrell in D2. He plunked $10,000 into the Alliance for Jobs and Sustainable Growth’s committee in support of Scott Wiener in D8. He plunked $45,000 into the Alliance’s committee in support of Theresa Sparks in D6. He dropped $45,000 into the Alliance’s committee in support of Steve Moss in D10. And he dropped another $25,000 into San Franciscans for a Better Muni, a committee in support of Measure G, which attempts to reform Muni by focusing on transit operator wages.

As the Guardian previously reported, this Alliance has received thousands from the SF Police Officer’s Association, the Building Operators and Managers Association, the Golden Gate Restaurant Association, and SEIU-United Healthcare Workers, which supports a mega-hospital on Cathedral Hill.

But Coates’ donation raises questions about his choices’ commitment to rent control. As Coates told the Chronicle in an interview in 2008, “There is a reason why 35 of 50 states expressly prohibit rent control by law – and the reason is it doesn’t work.”

Coates, who is a principal in Jackson Square Properties, which specializes in apartments and mobile homes, is also the founding partner of Arroya & Coates, a commercial real estate brokerage and investment firm whose clients include Walgreens, Circuit City, and J.P. Morgan Investment Management. And as campaign disclosures show, he’s dumped a large part of his money into the same conservative alliance that has already collectively spent almost $170,000 on Moss, Sparks and Wiener.

So far, labor has countered the Republican money by spending $70,000 in support of Debra Walker in D6 and $90,000 on Mandelman in D8, and the SF Tenants Union has spent a total of $20,000 on mailers opposing Moss, Sparks and Wiener. But collectively the downtown money, which is also being funnelled into several other independent expenditure committees, continues to massively outweigh the progressive bucks.

Coates’ phone line continues to register a “busy” signal, making it impossible to leave him a message, but I’d be happy to include his comments here, if and when I talk to him.

But Gullicksen said he was disturbed by Coates’ heavy spending on the supervisors’ races.

“Coates is the main funder of Prop. 98, his property is in Southern California, he’s pumping a lot of money into supervisors and he clearly has an agenda that we fear Moss, Sparks and Wiener share, which is to make the existence of rent control an issue the Board will take up, if those supervisors are elected.”

It will be interesting to see if Moss, Sparks and Wiener are prepared to pledge that they have no intention to attack rent control….so, stay tuned.

Meanwhile, labor is organizing a protest outside Coates office at 500 Washington Street at 5 p.m on Tuesday, Oct. 26.

“Be there or be evicted!” labor warned.

 

Downtown massively outspends progressives

With only three weeks until the election, downtown interests are massively outspending progressive groups.(Conservative estimates suggest a 5:1 ratio, based on an analysis of campaign finance disclosures at the Ethics Commission.) And these downtown interests have plenty in reserve, as cash is funneled into a bunch of improbably-named political action committees that hope to influence the outcome of district elections and local measures on the fall ballot.

The Alliance for Jobs and Sustainable Growth, which is backed by the Chamber of Commerce, the SF Police Officers Association, and United Health Care Workers, recently got an infusion of cash from the conservative-minded Building Owners and Managers Association and Golden Gate Restaurant Association. And the alliance is already spending gobs of money in support of Theresa Sparks in D6, Scott Wiener in D8 and Steve Moss in D10.

The Coalition for Sensible Government, which recently received a $100,000 injection of cash from the SF Association of Realtors, is spending in support of Sparks in D6, Wiener and Rebecca Prozan in D8, and Lynette Sweet and Moss in D10. The coalition is also spending in support of Proposition G (transit operator wages) and Prop. L (Newsom’s sit-lie legislation)  and in opposition to Prop. M (community policing/ foot patrols) and Prop N (property transfer tax).

And a PAC consisting of the Coalition for Responsible Growth, Plan C, San Franciscans for a Better Muni, SF Forward (sponsored by the SF Chamber of Commerce and SPUR) received $85,000 from the Committee on Jobs, $60,000 from the SF Association of Realtors, and $35,000 from SF Forward.

This PAC, which has already spent $466,000 this year, recently plunked down $1,000 to produce a voter guide for Plan C–a group that focuses on condo conversions and is endorsing Sparks in D6, Wiener in D8, and Sweet (as its first ranked choice) and Moss (as its second ranked choice) in D10.

It isn’t surprising that downtown PACs have deep pockets and almost identical slates. But it is a bit of a shocker that their slates are apparently almost identical to the Small Business Advocates, a group that has somewhat differing values and only a couple hundred members.

Reached by phone, SBA director Scott Hauge said the group has a couple hundred members–and claimed that SBA’s Board supports Sparks in D6, Moss in D10, and supports Measures G, K, L and opposes Measures J, M & N.

Hauge acknowledged that these positions are identical to those of downtown interests.
“We have been working with large companies,” Hauge said, claiming that small and big business’ interests are “the same” in this particular election cycle.

To date, neither the Chamber’s Steve Falk nor UHW’s Leon Chow have replied to the Guardian’s calls about the genesis of their so-called Alliance for Jobs and Sustainable Growth (Chow posted a comment on our politics blog and that is really not the same as a live conversation.)

But Tim Paulson, executive director of the San Francisco Labor Council wasn’t afraid to go on record in opposition to the Alliance and its 2010 slate.

“We’re really disappointed that there are labor organizations that feel they have to team up with Golden Gate Restaurant Association, which is against healthcare, and with CPMC [California Pacific Medical Center], which is working to keep nurses from joining a union,” Paulson said. “This alliance does not reflect what the San Francisco labor movement is about.”

A door hanger that the Labor Council distributed in conjunction with the SF Democratic Party confirms that both organizations support Debra Walker in D6 and Rafael Mandelman in D8. But while the Dem Party supports DeWitt Lacy, Malia Cohen and Eric Smith (in that order) in D10, the Labor Council only supports Cohen and Chris Jackson (in that order) in D10.

But despite their differing D10 candidate slate, both these progressive groups support Measures J, M and N, and oppose Measures B, K and L.

“When we see the Hotel Council stoop to attack Mike Casey, one of the greatest labor leaders in SF history, for fighting hotels who want to take away healthcare and diminish the retirement benefits for workers who make $25K to $30K a year, that’s really disturbing,” Paulson said, referring to a recent op-ed in the SF Examiner that was written by Patricia Breslin, executive director of the Hotel Council.

“And any union that makes an alignment with groups that don’t share the values of the San Francisco Labor Council, that’s really disturbing to me and the Labor Council,” Paulson said.

Noting that downtown is spending buckets of money on the election, Paulson observed that the Labor Council’s values are about “sharing the wealth.”

“So we don’t want Measure B [Jeff Adachi’s pension reform] or K (Newsom’s hotel tax) or L (Newsom’s sit-lie legislation),” Paulson concluded. “And we have three solid weeks to do this.”

Downtown money hits district races

Downtown cash is pouring into the district supervisorial races.

Ethics Department filings show that an alliance backed by the Chamber of Commerce, the SF Police Officers Association and United Health Care Workers West is dropping major money on Steve Moss in D10, Scott Wiener in D8 and Theresa Sparks in D6. 

Called the “Alliance for Jobs and Sustainable Growth,” the coalition supports the building of a mega-hospital on Cathedral Hill.

The independent expenditure alliance puts UHW, part of the Service Employees International Union, in the odd position of using membership money to attack progressive politics in San Francisco – potentially undermining years of work by another SEIU affiliate, Local 1021.

Campaign disclosure forms show that the Chamber-Police-UHW alliance has spent $20,000 on bilingual (English/Chinese) door hangers for Moss that feature photos of Chamber of Commerce President Steve Falk and United Healthcare Workers political director Leon Chow.

These same interests also spent $20,000 on robo-calls for Moss, with a heavy focus on Visitacion Valley in an effort to secure the Asian vote in the crowded D10, where there is a strong likelihood that the race will be decided by second and third place votes

Word on the street in the Bayview is that former Mayor Willie Brown is pissed off that the Chamber is backing Moss, instead of African American candidate Lynette Sweet, and that termed out D10 Sup. Sophie Maxwell is angry that big corporations are trying to buy an election in the poorest and most ethnically diverse district in town.

But unlike the rumor mill, the money trail doesn’t lie. And from that perspective this is looking like a replay of the June 2008 election, when big businesses bought support for Lennar’s Candlestick Point/shipyard development by claiming it would create thousands of jobs building condos that most workers can’t afford—jobs that have yet to materialize.

This time the battle cry is for jobs building a massive hospital, even though few workers will likely get service from this hospital, which is designed to serve as a regional center for high-end health care.

So far, the same alliance of police and corporate money has plunked down $17,000 for bilingual (English and Chinese) door hangers in support of Theresa Sparks in D6 and another $17,000 for bilingual robo-calls in support of Sparks.

And so far, Scott Wiener has gotten the relatively short end of the corporate money stick: the Alliance has only spent $15,000 on a door hanger in support of Wiener.

This means that the alliance spent $90,000 in a two-week period in September. The numbers lend credence to DCCC Chair Aaron Peskin’s belief that the alliance has a war chest of $800,000, which it intends to use to put pro-downtown candidates into power.

Asked about the support of this alliance, Sparks, Wiener and Moss gave markedly different replies that reveal as much about each candidate as the money behind them.

D6 candidate Theresa Sparks suggested that the Alliance was spending more on her and Moss’ D10 campaign, because it felt Wiener was further ahead in the D8 race than she is in D6 or Moss is in D10.

And Sparks was openly supportive of the Cathedral Hill hospital project. “I’ve been very supportive of that project,” Sparks told us.

Sparks also observed that it was logical that the Chamber would support her.

“D6 has one of the largest numbers of small businesses and one of my biggest platforms has been economic growth, and I think the Chamber has been very supportive of job creation,” Sparks said.

By comparison, Scott Wiener told the Guardian that he has not taken a position on CPMC’s proposed mega hospital on Cathedral Hill.

“Those kind of issues could come before the Board, in terms of CEQA issues, and so I could be conflicted out,” Wiener said.

When the Guardian noted that the Alliance has so far not spent any money on phone banking for Wiener in D8, Wiener said, “I have volunteers doing phone banking.”

As for Moss, he told the Guardian that said he doesn’t have a position on the mega-hospital.

“I haven’t seen the plan,” Moss said. “But I understand that there seems to be an agreement that would maintain St. Luke’s with about 300 beds, but that there is a deep suspicion among the nurses that it’s not economically viable. And there seems to be a much greater need for a hospital in the southeast.”

Moss, however, is with downtown on other key issues: He supports the sit-lie legislation on the November ballot. He also reiterated that he likes the rabidly anti-tenant Small Property Owners Association, whose endorsement he called a “mistake” during a previous interview with the Guardian.

“Landlords feel that they are responsible for maintaining costly older buildings and that they are not provided with ways to upgrade their units in ways that share costs with tenants,” Moss, who sold a condo on Potrero Hill in 2007 for the same price that he paid for the entire building in 2001, and owns a 4-floor rent-controlled apartment building in D8, near Dolores Park, that he bought for $1.6 million in 2007, and where he lived from December 2007 to February 2010.

Moss refused to provide a copy of the lease on his current rental at Vermont and 18th St—something that the Guardian requested in light of an email from his wife that indicated that the family intended to move back to Dolores Park of Moss loses the race.
‘That’s private information,” Moss said, claiming that he does not plan to move back into his apartment building in D8, if he loses in November.

Moss claimed that UHW endorsed him because his position on politicians and unions.
“I agreed that politicians should get not involved in union politics,” Moss said. “The United Healthcare Workers seem to be a worthy group,” he added. “All they said was that they wanted to make sure that they had access.”

All this campaign money drama is playing out against the backdrop of a punishing battle between United Healthcare Workers West and the rest of SEIU. And as these recent filings show, UHW is spending a huge amount of its membership dues to undermine the city’s progressive infrastructure by trying to elect candidates who are not progressive, even though its progressive sister union has endorsed Rafael Mandelman in D8.

SEIU 1021 member Ed Kinchley, who works in the Emergency Room at SF General Hospital, is furious that UHW is pouring all its money into downtown candidates like Moss, Sparks and Wiener and trying to undermine everything that its progressive sister union is trying to do.

“UHW basically isn’t participating in the Labor Council, it’s just doing its own thing,” Kinchley said.

Kinchley noted that UHW is currently in trusteeship, and is being controlled by its International, and not its local membership, thus explaining why it’s doing this dance with forces like the Chamber and the Building Owners and Managers Association, which have long been the enemy of labor.

“Sutter wants a monopoly on private healthcare, and people like Rafael Mandelman in and Debra Walker have been strong supporters of public healthcare,” Kinchley said, Kinchley also noted that he wants supervisors who are willing to state their support for public health care, rather than dodging the issue and hedging their bets, right now.

“I want someone who can straight-up say, here’s what’s important for families in San Francisco, especially something as important as healthcare,” Kinchley said. “but it sounds like UHW is teaming up with the Chamber and supporting people who are not progressive.”

“And it’s not OK for somebody in D10 to say they haven’t seen CPMC’s plans, when people from D10 use St. Luke’s all the time for healthcare, because it sounds like Sutter wants to change St. Luke’s into an out-patient clinic for paying customers,” he continued.

SEIU 1021 activist Gabriel Haaland accused the Chamber, the Building Owners and Managers Association, UHW and the Police Officers Association of putting together a massive political action committee, “to try and steal the election through corporate spending.”

All this leaves the Guardian wondering how Leon Chow, the political director of UHW, who has done good work in the past on health care issues, is feeling about seeing his photograph spreads all over town alongside that of Chamber of Commerce President Steve Falk on door hangers in support of Sparks, Wiener and Moss.
 
As of press time, Chow had not returned our calls, but if he does, we’ll update this post.

Prop. B will save healthcare

Editors note: Last week we ran an op-ed by Assemblymember Tom Ammiano opposing Proposition B. Public Defender Jeff Adachi asked for space to respond. His position follows.

OPINION San Francisco prides itself on the excellent health care services it provides to its residents. Per capita, San Francisco provides better quality healthcare to its poorest and most vulnerable residents than any other city in our state. Our city’s Healthy San Francisco program, which provides low- cost access to healthcare for all uninsured residents, has been heralded as a model program nationwide.

But the healthcare system that serves the city’s employees is teetering on the brink of insolvency. This year, the city will spend $456 million for healthcare costs for 26,000 city employees, and 28,000 retirees and their 47,000 dependents. According to the Controller’s Office, the city’s health system has an unfunded liability of $4 billion — meaning that it has made $4 billion in promised coverage to city employees and their dependents that it doesn’t have the money to pay for.

That’s a major reason why two city departments that serve the poorest residents, the Public Defender and Public Health, must cut millions of dollars of essential services each year, to save the city’s General Fund for growing employee healthcare and pension costs.

Currently most city employees contribute nothing for their own healthcare. Taxpayers subsidize the entire cost, which runs between $2,890 and $5,560 per year for each employee. Proposition B would change this by requiring that an employee insured under the basic health plan pay just $96 a year ($8 a month) for their healthcare. Under Prop. B, city employees would still pay 22 times less than private sector employees, who pay an average of $2,185 per year for their health insurance.

City employees with dependents currently pay $8 a month. Under Prop. B, they would pay $2,988 per year. Private sector employees with dependents pay an average of $7,026 a year. And this doesn’t include the 31 percent of San Franciscans who do not receive employer-paid health care costs and pay the entire cost themselves.

Opponents of Prop. B claim that city workers cannot afford to pay the health benefits if Prop B. passes. Their argument ignores the fact that the average San Francisco city employee earns $93,000 a year in salary alone, excluding benefits, while the average private sector salary is $46,000.

They also argue that “a single mother will be forced to pay up to $5,600 per year for her child’s health care — in addition to the $8,154 she already pays.”

First, this is not true. A city employee with two dependents only pays a total of $448 a month for full health coverage. Only if the city employee chooses the most expensive health plan, which costs $31,645, would the employee have to pay $19,561 a year under Prop. B instead of the $16,922, which he or she now pays.

Even with contributions required by Prop. B, city employees will receive a benefit package that is unparalleled in the private sector. Even more important, the city’s healthcare fund will be made more sustainable by ensuring that the funding for the city’s healthcare program doesn’t run dry when the city can no longer afford to pay these costs.

According to the Controller’s ballot statement, Prop. B would save the city $121 million annually. Some of these funds could be used to prevent the devastating cuts to the city’s mental health, substance abuse, and other community health programs for poverty-stricken adults and children who do not have healthcare coverage.

Voting yes on Prop. B is an antidote to continuing cuts to healthcare for the poorest San Franciscans. *

California Pacific Medical Center’s plan to build a massive new regional hospital on Van Ness shouldn’t be under the jurisdiction of the Planning Commission

EDITORIAL More than 100 people showed up at the Planning Commission Sept. 23 to oppose California Pacific Medical Center’s plan to build a massive new regional hospital on Van Ness Avenue. Most were neighborhood residents who raised an excellent point: what, exactly, would the shiny new $2.5 billion hospital offer for low-income people in the Tenderloin?

And that’s just the starting point for discussion. The new project is a piece of a much larger plan: CPMC wants to shut down part of its Laurel Heights campus, reduce the number of beds and the scope of service at St. Luke’s, turn Ralph K. Davis into a specialty facility, and reshape the way health care is provided in San Francisco.

That’s a huge deal — but right now, the city is looking at the projects piecemeal. That’s poor public health policy and poor land-use planning. In fact, there’s no real way to evaluate the Van Ness hospital in its proper context — the Planning Commission, which will rule on the development issues, is hardly the best venue in which to discuss the future of health care in San Francisco.

So new legislation by Sup. David Campos is critical to injecting some sanity into this, and the larger, health facilities debate. The Campos legislation would mandate a citywide Health Care Services Master Plan and would require that all new hospital development, public or private, be consistent with that plan. It’s a pretty basic concept, and it’s hard to imagine that nobody’s suggested this before.

San Francisco has a large, complex network of facilities providing health care — a big public hospital, a university hospital system (University of California San Francisco), a series of public and nonprofit community clinics, half a dozen private hospitals run by two competing chains (CPMC and Catholic Healthcare West), and one health maintenance organization (Kaiser). Some provide unique services, some provide competitive services — and there are some critical services that are hard to find anywhere.

It’s hard to say whether the city needs what CPMC is proposing — a gigantic medical center that some have described as the Mayo Clinic of the West, designed to attract patients from all over the region — without any sort of overall plan. How would the new facility and the CPMC restructuring affect services at St. Luke’s, a critical part of the health care infrastructure in the Mission? Where would patients who rely on Davies for emergency and clinical care in the Castro district wind up? How about all the medical office buildings and doctors’ offices situated near hospitals that are about to change?

How will CPMC’s moves affect low-income-patient care? How does the project fit in with the new Obama health care policies and the city’s own Healthy San Francisco program? Will a new hospital on Van Ness increase access to primary and emergency care for residents of the Tenderloin — or will they be shuttled somewhere else while the high-end facility caters to better-off patients seeking expensive specialty procedures?

Those aren’t land-use decisions — and while some Cathedral Hill residents argue that the new hospital will cause traffic problems, the biggest issues go beyond the scope and expertise of the city Planning Department.

Under the Campos bill, the Public Health Department would develop a master plan (which public health director Mitch Katz says can be done with existing resources), the Health Commission would review that plan, hold public hearings, and sign off on it — and city planners and health officials would have to make sure that new health-related development met existing and future public needs.

The supervisors should pass the bill and get the process going as quickly as possible. And they should refuse to sign off on any final version of the hospital plan until there’s a city framework in place — or at the very least, until CPMC can demonstrate that its citywide infrastructure plans are designed to meet public health needs. *
