An explosive issue

Do you know where your natural gas shutoff valve is? Are you going to need a wrench to turn it off? If the ground starts shaking and the ceiling is coming down on your head, are you going to be thinking about your pipes cracking and spewing high-pressure, flammable natural gas into your home?
Probably not, which is why automatic shutoff valves were developed. They trip and kill the gas flow to the pipes inside your house when seismic activity is greater than 5.2 on the Richter scale.
Right now, the city puts its faith in citizens to be ready to kill the gas if the big one hits. Not all cities agree with this policy. After the Northridge earthquake in 1994, Los Angeles passed an ordinance mandating automatic shutoff valves in all new construction and for home repairs greater than $10,000. Alameda, Contra Costa, and Marin counties have similar legislation, as do the cities of Pittsburg and Hercules. Why not earthquake-prone San Francisco?
That’s the question being explored by the city’s Department of Building Inspection (DBI). But there are other questions too: if San Francisco decides to make a policy requiring automatic shutoff valves, can they be installed more expeditiously than the 11 years and counting it has taken Los Angeles?
DBI staff, building inspection commissioners, and city officials from the Fire Department and the Office of Emergency Services held an initial Aug. 30 meeting on the issue, and though it’s too early to tell how San Francisco could mandate installation of these valves, the sentiment was that the status quo strategy of public education is not enough. The discussion also revealed some key questions about where exactly the valves can be installed, who is responsible for them, and who’s going to pay.
In San Francisco there are currently two ways the gas can be shut off when there’s a leak: either Pacific Gas and Electric Co. or the customer can do it. PG&E provides manual shutoff valves at all installations, but they can be difficult to operate, especially for a disabled or senior citizen.
PG&E officials say they don’t have a position when it comes to recommending whether automatic shutoff valves should be installed.
“Because we serve such a large, diverse customer base, our position is a neutral position. We do not support or not support installation of these devices,” PG&E’s Paul Brooks said at the meeting.
Brooks, a senior gas engineer for PG&E, said the company has manual valves for the main gas lines but confirmed that there is nothing in the system that trips automatically during an earthquake. PG&E is responsible for the health of the pipes up to where they meet the meter, after which the customer is liable.
PG&E has been replacing old pipes throughout the city with polyethylene lines, which are designed to flex more before snapping when the ground shakes. In some places, the new pipes allow for gas to be delivered faster, at a much higher pressure. That’s a problem, says Building Inspection Commission president Debra Walker, who’s concerned about the danger of higher-pressured gas being piped into people’s homes.
“We have a unique situation here in the city because of our property lines,” she told the Guardian after the meeting. In San Francisco, it’s common to construct buildings right up to the lot lines, milking every inch of property and making it necessary to put gas meters, gauges, valves, and gas pressure step-downs underneath the structure.
“A lot of these gas lines go into the building before the step-down. The problem and the risk are already in the building,” Walker said. She argues that automatic shutoff valves should be placed farther up the line and PG&E should assume some responsibility for the installation.
Only PG&E could install them. Since 2002, the California Public Utilities Commission (CPUC) has disallowed customers from installing automatic shutoff valves on the gas company’s side of the meter. Fabian Padilla, a former Southern California Gas Company employee who was at the meeting, said utilities lobbied for the prohibition to avoid liability if valves were improperly installed on the gas company’s side.
Brooks cited the CPUC’s general orders when asked whether the company could assume responsibility for installing shutoff valves on their lines and said they would have to be responsible for the valves as well. He didn’t know if that was something the company would be willing to do.
After the meeting, Padilla told us, “It’s obvious that the best way to do it is on the gas company’s side of the meter.” Padilla, who is now president of Affordable Safety Solutions Inc. (ASSI), a company that designs and distributes earthquake gas safety devices and specializes in automatic shutoff valves, thinks company-side installation is easier and more economical because the lines are smaller, the gas doesn’t have to be turned off to install the valves, and in San Francisco’s case, where the meters are under the buildings and difficult to reach, it’s easier to install them elsewhere.
Cost is the other major factor. Padilla said he offers valves and installations for $245 to his Southern California customers. The DBI estimated costs between $250 and $600 per meter, which becomes a pricey endeavor for multiple-dwelling buildings where each unit has its own meter and consequently, its own automatic shutoff valve.
It’s a cost some are concerned that landlords would defer to the tenants. A few hundred dollars for a valve may seem like a worthy investment to most homeowners, and even though your neighbors also benefit when your house doesn’t blow up, not everyone may be willing to throw down for the lifesavers.
The cost to install valves in every household could be enormous, but city officials at the meeting seemed unwilling to issue a mandate without offering some kind of financial assistance. Though it seems unlikely that PG&E would incur the costs as a good-neighbor gesture, the possibility of funding from the city’s office of emergency services or the Federal Emergency Management Agency is being considered. Officials said more research and risk assessment needed to be done, and meetings are being scheduled where the key questions of who pays, where the valves will go, and whether they will be put into widespread use before the big one may get answered.
“It’s very important that we resolve this issue,” Walker said to us after the meeting. “There are challenges around where these valves are and who will be responsible.” SFBG

Eat your politics

A lot has happened since Californians first rebelled against the canned food and Jell-O molds of the postwar industrialization era. The American food politics revolution is very much alive and well and thriving in the Bay Area, where the movement started. And California is still the food basket of the United States — it’s been the top grower in the country for more than half a century. The dialogue about sustainable growing practices and environmental impact is open, and the fight for more mindful production practices is still on.
We are home to around 100 farmers markets — including Alemany, which, at 63 years old, is the granddaddy of local markets. Alice Waters’s groundbreaking Chez Panisse restaurant celebrated 35 years of organic-minded Epicureanism this year. CSAs (Community Supported Agriculture farms) — started in the United States in the 1980s — are going strong. Local groups and organizations that continue to educate and activate the revolution around here include but certainly aren’t limited to San Francisco Food Systems, Food Not Bombs, Food First, and the Brentwood Agricultural Land Trust, which protects farmland against development. Blogs like the Eat Local Challenge, written by authors across the United States, and resource Web pages like those of the Center for Urban Education about Sustainable Agriculture, the organization that runs the Ferry Building farmers markets, offer a plethora of information about the local food politics movement.
And then there’s Larry Bain — restaurateur, activist, and founder and executive director of Nextcourse. He doesn’t just eat his politics, he feeds them to the Bay Area. Bain has a hand in a few of the finest and fanciest restaurants in town (Acme Chophouse, Jardinière), but his work through Nextcourse in San Francisco jails and schools and with the Golden Gate National Recreation Area narrows “the food divide” and shows how eating well doesn’t mean breaking the bank for artisanal olive oil. We talked to him about his organization and some of the major issues it’s taking on in the quest to bring mindful eating practices to the larger community.
SFBG What inspired you to found Nextcourse?
LARRY BAIN I’ve been a food activist since 1983, when I opened [Zola in San Francisco] with the intention of creating a new model for restaurants. Restaurants use more energy per square foot than any other retail operation, so the consumption of water, gas, electricity, and the generation of greenhouses gases tend to have a very deleterious impact on the environment. Then there’s the cleaning solutions used in restaurants. And the amount of garbage generated, the packing, and then of course the stuff we know and think first about restaurants, where food comes from, the fossil fuels used in the creation and transportation of food. Every year I owned a restaurant, I got more excited about the positive impact restaurants could have and about finding ways to influence other restaurateurs. Because nobody wakes up in the morning and says, “I want to be the cause of 17 trees being felled in the redwood forest.”
But I wasn’t big enough to take it all on. Every issue is far more complex than you’d think. Whether it’s a straightforward Atlantic salmon or a Chilean sea bass, there are layers of impact. Even eating local — what does that do to communities that depend on people in America buying their coffee beans or some other product? I wasn’t sure where to focus until I went to a seminar that was given at the UC Berkeley School of Journalism. All of my heroes were up on the stage: Vanda Nashiva, Orville Schell, Wendell Berry, Michael Pollan, Carlo Petrini. They were being eloquent and brilliant about the future of food and where we needed to be going, touching many things close to my heart.
As always happens at one of those gatherings, some smart-ass stood up and asked, “Excuse me, if we were going to make the transition from conventional to organic tomorrow, would we still be able to feed the world?” It’s the argument always thrown out by Archer Daniels Midland: “This is the only way to feed the world, through genetically modified crops and by conventional methods of distribution. All of this organic stuff is just pie in the sky.” And everybody, all of my heroes said, “Oh yes, organic farming is superproductive. You get a lot more nutrients out of every acre planted.”
Berry said, “We just don’t have enough farmers. If you went to the unemployment office and said, ‘OK, all you three guys over there, tomorrow you’ll be organic farmers’ — it requires tremendous wisdom and experience and we’ve lost that. Before we can talk about changing our food system, we have to be cognizant of the supply, and we don’t have the farmers and we don’t have farmland.” It was at this point that I thought, OK, this is going to be my passion, growing farmers.
I don’t know anything about agriculture. My area of expertise is the world of commerce, and I know what farmers need is a good path to sell their product. And because farmers cannot survive through Chez Panisse alone, they need a broader base of consumers that might be willing to buy things that aren’t as exotic as a $5 peach but greens or even fruit that is delicious but not beautiful.
SFBG Has cooking become some exoticized thing?
LB Elitist thing. People go to the Ferry Building not to buy their food but to accessorize their meals, and so what they’re going to eat is pretty standard stuff that they might get at Safeway or Whole Foods, and then they go to the Ferry Building to get this little bunch of herbs or this little piece of cheese that will make it a special dinner. And so how do you make shopping in farmers markets and cooking for your family more of a way of life rather than a lifestyle. When you’re living in a neighborhood filled with tension and stress and toxic materials, food becomes even more important to help you survive that, to help you keep a strong immune system. So Nextcourse started in the San Francisco county jail working with women who are moms, mostly, and who, once they get out, need to feed their family.
SFBG When did the cooking in jail program start?
LB I got a phone call from a teacher at a school in Emeryville to come and talk to students there about healthy eating. I took the chef and sous-chef from Acme Chophouse, and we cooked with the kids. A friend of mine said this would be a great program at juvie hall. And so I called juvie hall — it was a bureaucratic nightmare. The same friend said, “Well, I know someone who does work at the county jail. She’s a public defender.” So, I called her up and told her, “We want to do cooking classes in the jail. I’ve got these great chefs, and they know how to show people how to cook things that are delicious, nutritious, easy, cheap, fun. Can you help us out?” Within a week we met with the sheriff, who loved the idea.
In the classes, we talk about the importance of nutrition and the how-to. A lot of these women know that eating good food is important for their kids. They know this, and yet they think, “What can I do about this? I can’t afford to go to Whole Foods, and I can’t afford to eat at Chez Panisse.” So we show them where to shop, and every class has a menu. The teacher will shop the day before, both at Safeway or FoodCo or one of these cheap stores and at a farmers market — not at the Ferry Building but at Heart of the City or at Alemany or sometimes just at stores in the Tenderloin. And we line the ingredients up side-by-side and invariably the ingredients from the farmers market, aside from being more nutritious and delicious, are cheaper because we shop seasonally.
All of the cooking takes place with minimal equipment. In the jail we can’t use knives. Everything can be done — a salad, a main course, a vegetable — in 25 minutes, and for less than $5 a person. Cooking quickly is all about being organized. We teach them those skills as well.
SFBG How many women have gone through this program?
LB I think it’s about 750 now. One of the things that we’re moving forward with is finding a way to connect with the women after they leave. One of the new initiatives is working with a postrelease program where there’ll be a kitchen so we’ll be able to do the classes on an ongoing basis.
SFBG Something that a lot of people don’t know is that people who have a felony drug offense can’t get food stamps.
LB It was part of that whole clean up drugs thing. It’s changed slightly so that now if you have a minor drug offense, you can get food, but if you have a heavier felony offense, it’s still not possible. [Assemblymember] Mark Leno is working on fixing it.
SFBG Have you kept in touch with the women from the program?
LB Yeah. We have one woman who found us because we also offer the courses to women who provide day care. She told us, “When I was in jail, I was thinking this was all bullshit. I can’t do that. It’s going to be too expensive. It’s just you white people blowing smoke up our ass. But I got out and now I’m going to the market every week and my kids love it.”
SFBG You’re also coordinating food service for the Golden Gate National Recreation Area?
LB Yes, coordinating purchasing so the prices are better, but also coordinating so some people can get products that there hasn’t been enough demand for. The great thing about McDonald’s is that it represents this huge buying power, and if McDonald’s says, “We want an alternative to Styrofoam,” people say, “OK, we’ll do that.” So when 17 food services here say, “We really want cornstarch knives or sugar-based packaging material” … companies will see this opportunity and figure it out.
I started talking to the people in the national park for two reasons. One is that the park feeds a lot of people. Golden Gate Park is 75,000 acres, the largest urban park in the country, and feeds 17 million people a year, whether they’re dining at Greens, which is a park partner, or the Cliff House or some little café. The park also sits on a tremendous amount of good agricultural land, some of which is being used up at Point Reyes National Park. Cowgirl Creamery, Strauss Dairy, Hog Island Oyster, Sun Farm — all those are on park land. We want the park to become not only a purchaser of good sustainable, healthy food but also a producer.
SFBG One of the reasons why Nextcourse is interesting is that it addresses the “food divide,” actually doing outreach into the community that is not going to show up at the Ferry Plaza Farmers Market. What do you think needs to be done? It feels like the gap is getting wider rather than narrowing.
LB That just represents what’s happening in our society. Truly, you can’t change the food system without looking at every other aspect of the economic system. You’ve heard it before, but there’s all these wonderful catchphrases like “the high cost of cheap food.” People shouldn’t be asking why this beautiful piece of fruit is so expensive, they should be asking why this other piece of fruit is so cheap. And the reason it’s cheap is because of the way our economy is structured, with lobbies, subsidies, and oil companies having such a strong vested interest. The real problem with food costing “X amount” is that we can’t survive just on food. We need housing, we need education, we need health care. The government is no longer in the public service business: they’ve privatized all of those things, and they’re driven by profit. People can’t afford more expensive food because they’re spending so much on rent, health care, and more expensive schools.
We’ve created a society that’s increasingly divided the rich and the poor. Food is just symbolic. If we want a just society, this is just one aspect — don’t stop at food, but see food as the beginning, a way to engage in a better world.
SFBG What about the conceptual problem? It’s fine to repeat the mantra that cheap food is more expensive, but when it’s not immediately visible …
LB We’re encouraged to not see beyond our own noses. It’s not in the interest of economy for us to think of long-term effects, to see the net. We just see “cheap.” This is the money I have in my pocket at the moment. I’ll worry about the hospital when I have to go to a hospital, and in fact, it’s best not to think about that. So in order for things to change, food people need to see that while they need to collaborate among the food community, they also need to collaborate among the social justice community as a whole. The food community has to see that people struggling for immigration rights, workers’ rights, health care rights are their natural friends.
SFBG What are some organizations around the Bay Area that are doing good work?
LB On a really grassroots level, I think la Cocina is fantastic — an industrial kitchen facility that brings in mostly Latina women with the hope that they’ll be able to have their own kitchen or restaurant someday. The Columbia Foundation, particularly through their Roots of Change program. Something new to the Bay Area is the Community Alliance for Family Farmers that is trying to bridge the gap between farms and urban centers.
SFBG What are the top issues facing the Bay Area — in terms of food and our ecology — in the next decade?
LB The offshoring of our food production. It’s going to happen unless we start yelling and screaming, because it is so much cheaper to grow and produce food in developing nations. A lot of these agribusiness companies want to get out of the US. They want to be someplace where there are no labor laws, there are no environmental restrictions. That’s what keeps me up at night. I wake up in the middle of the night screaming, “They’re offshoring our food production.”
Environmentally, water is the biggest issue that we’re facing. What’s happening is that farmers are saying, ‘I could sell my water for much more money than I could ever make growing food.’ Because all of our communities, particularly those built in deserts, are so desperate for water that they will pay anything for it. So as water becomes more politically contentious and expensive, anybody doing agriculture will go someplace where there isn’t necessarily more water but they can get it for free or get it illegally. Saving women from themselves

OPINION In the name of protecting sex workers, a few San Francisco activists have adopted the rhetoric of antiprostitution advocates and taken their case to the San Francisco Commission on the Status of Women (COSW). The commission, following this lead, has adopted a controversial strategy — opposed by the vast majority of dancers, activists, and sex educators — to close down VIP rooms, private booths, and private areas in adult clubs and repeal “encounter studio” permits, claiming that privacy in commercial sexual contexts must be stopped because it causes prostitution, sexual assault, and AIDS.
For starters, the AIDS claim is wrongheaded: starting 30 years ago, activists around the world have explained that the way to address sexual health is not to drive people further underground through this exact sort of repression.
Beyond that, the legislation put forward by the COSW echoes contemporary moral panic. This law uses terms that have historically been used to curtail our freedom under the guise of protecting women. For example, the proposed bill claims that prostitution is “coerced” — but that depends on how you define coercion.
Forced labor and coercion are serious crimes in the legal framework. But economic coercion is the motivation for many types of work, and the fact that women are coerced or forced into this work is being used to justify prohibitions that affect all sex workers. The term “sexual exploitation,” which also comes up in the legislation, has been used to describe (and curtail) the voluntary commercial activity of sex workers.
The commission claims it based the proposal on testimony from dancers but omits the fact that the vast majority of dancers rejected the approach, showing up in droves at hearings. Of course, dancer and sex worker rights activists support some strategy to address complaints about unfair labor practices, exorbitant commissions, safety concerns, and harassment — but no effort was made by the COSW to find a consensus.
The campaign developed by the COSW places dancers in closer alliance with management as both dancer options and management options are being threatened. This phenomenon is part of Sex Worker History 101. The current dancers are further alienated and discouraged by this dynamic from organizing to improve working conditions. Unraveling this dynamic is necessary to further labor advocacy in this industry. The issue of private booths distracts from the problems of illegal stage fees, contractor versus employee labor issues, and Occupational Safety and Health Administration regulations.
Other parts of the plan include allowing COSW representatives to inspect the workplace and to “notify the Commission on the Status of Women when they make any change to the compensation schedule.” Now there’s a great idea: put the classy female elders of San Francisco in charge of working-class women in the sex industry.
This legislation sets some very troubling precedents. Solutions to problematic working conditions in clubs should be developed by the workers, with assistance from labor experts. Given the level of polarization this proposal has created, that could take some time. SFBG

Gerald E. Grilly, executive vice-president and chief operating officer, got $l50,000. More: Grilly, according to the filing, “will retire from the company effective Aug. 3l, 2006. In connection therewith, Mr. Grilly will receive severance of $l.25 million payable over three years, as well as payment of his fiscal 2000 performance bonus of $8l,250 and $35,000 in connection with the forfeiture of his rights under the company’s supplemental executive retirement plan.”

Anthony F.Tierno, senior vice president of operations, got $50,000 and Eric Grilly, president, MediaNews Group interactive, got $75,000.

The moral: there’s lots of money to be made amongst the top executives of newspapers when they do their monopolizing. But, as we shall find, there’s not much money if any, for the rest of us. In fact, there are enormous upfront and longterm costs to staffers, readers, advertisers, the health and welfare of the community, and the marketplace of ideas principle underlying the First Amendment.

And then there is the juicy legal boilerplate laying out the end of real daily competition in the Bay Area for the duration: “On August 24, 2006, in connection with the consummation of the acquisition by MediaNews Group, Inc…of the Contra Costa Times and the San Jose Mercury News, and the entry by the company into an agreement with the Hearst Corporation pursuant to which (l) Hearst agreed to make an equity investment in the Company (such investment will not include any governance or economic rights or interest in the company’s publications in the San Francisco Bay Area and (ll) the Company agreed to purchase The Monterey Herald and the Saint Paul Pioneer Press from Hearst concurrently with the consummation of such equity investment, the Company awarded bonuses to certain of its officers and employees in the aggregate amount of $l.875 million, including bonuses to the Company’s named executive officers as set forth below.”

Let us save and cherish the delicious key phrase: one of the great whoppers of all time: “such investment will not include any governance or economic rights or interest in the company’s publications in the San Francisco Bay Area…” Translation: this is Hearstese and Singletonese stating in effect: there will be no more of this messy and expensive competition stuff from now on. Trust us.

Remember when Phil Bronstein, editor of the Hearst-owned Chronicle, and Susan Goldberg, editor of the now Singleton-owned Mercury News, made some loud, brave noises early on about how the papers would still compete like hell, no matter how intertwined the companies were on the business side? Bronstein and Goldberg and their editors have a tough job selling this propostion to their staff and communities. I’m afraid the way Hearst and Singleton have put the axe and the shovel thus far to the conglomeration story is a telling sign of what’s to come.

The Bronstein/Goldberg statements violate Brugmann’s Law of Monoply Journalism: when there is no real economic competition between newspapers, then there is no real news and editorial competition between newspapers. Alas. Alas. We shall see. Let us hope for the best. The Guardian and the B3 blog will be watching.

San Francisco’s top officials want to get the city more directly involved in creating a better telecommunications infrastructure. Their goal is to overcome the digital divide and pump up the city’s overall bandwidth without waiting for the private sector to maybe get around to it.
But Mayor Gavin Newsom and the San Francisco Board of Supervisors have focused on distinctly different pathways to the whiz-bang future they both envision. And the agency in charge of getting the city there — the Department of Telecommunications and Information Services (DTIS) — has moved the mayor’s big idea at high speed while inching the board’s plan along at a snail’s pace.
Newsom first proposed a citywide wireless Internet system that would be free for the city and its residents during his State of the City speech Oct. 21, 2004. At the time it was just an ambitious promise that seemed to languish, until late last summer when the DTIS issued a request for information to a variety of high-tech firms.
By the end of 2005 the city had settled on trying to negotiate a deal with a partnership between Google and Earthlink to build the system, which they will finance largely with revenue from targeted advertising and users who pay a fee for faster connections. City officials are still in negotiations with Earthlink and expect to have a proposal ready for the board to consider by the end of the year.
Yet three weeks before Newsom announced his intention to pursue wireless, Sup. Tom Ammiano and a coalition of public interest nonprofits announced a plan to have the city build and run a municipal broadband system by laying fiber-optic lines as city officials open up the streets for the planned sewer system replacement and other projects.
It was an ambitious idea never realized by a big city in the United States, one that would put tremendous bandwidth directly under city control and be a potential source of millions of dollars in annual revenue and cost savings.
Now, almost two years after the Board of Supervisors ordered a study on the plan, the DTIS has finally hired consultants — the Maryland-based Columbia Telecommunications Corp. (CTC), which works exclusively on fiber-optic projects for public agencies. The first draft of the plan is expected to be available for public comment by the end of the year.
“We consider both the wireless and fiber projects to be important,” Brian Roberts, the DTIS senior policy analyst for both projects, told the Guardian. “But we thought wireless would be something that could be accomplished in a relatively short timeline.”
Roberts and others involved in the projects say the two ventures aren’t mutually exclusive — that any wireless system would actually get a big technological boost from city-owned fiber, San Franciscans will likely use up whatever bandwidth they can get, and wireless reaches mobile users in a way that fiber can’t.
But activists of various stripes have catalogued a number of concerns with Newsom’s wireless plan: the secretive nature of the early negotiations, private sector control over the system, the mayor’s relationship with the Google founders (who proposed the idea in the first place), the exposure of residents to increasingly sophisticated advertising campaigns, shortcomings in serving the poor and truly breaching the digital divide, and problems associated with wireless technology (mainly involving reliability, health, and capacity concerns).
The fact that these two plans are coming before the Board of Supervisors at the same time — which Roberts said is purely coincidental — is likely to renew the age-old debate about privatization and public interest.
Should the city be pursuing the public-private partnerships favored by Newsom, which can be delivered to voters quickly and at seemingly little cost to government? Or should it be focusing on long-term strategies that will give the city more control over the resources its citizens need — from electricity to information technology — without having to depend on the profit-driven private sector?
The DTIS announced the commencement of the municipal broadband study during a little-noticed public meeting Aug. 15, during which a dozen or so of the most committed activists, representatives for Comcast (which aggressively opposes most municipal broadband initiatives), and downtown building owners heard from the consultants.
CTC founder and principal analyst Joanne Howis outlined the scope of her firm’s study and sang the praises of what’s known in her industry as Fiber to the Premises (FTTP), noting that it’s the most reliable, high-capacity broadband technology and that the price of delivering it to people’s homes has fallen tremendously in recent years, to the point where it’s the best all-around broadband delivery system.
“Fiber is better, and wholly controlled fiber is better still,” she said. “That’s an article of faith with us.”
Later, activists pushed the point on wireless versus fiber. “Fiber can do many of the things wireless can’t do, but it can’t go mobile,” Howis said, also noting that fiber is essential to a reliable public safety system. “Fiber and wireless speak to different needs and are used in different ways.”
But when asked what’s better for residential users, she said, “Anyone who can have fiber or wireless to their homes will choose fiber.”
“Unless it’s free,” Roberts interjected.
But public interest media advocates like Media Alliance say the city is going about this backward. The group has been critical of the city’s wireless plans and has studied the potential for municipal fiber, arguing in the just-released report “Is Publicly Owned Information Infrastructure a Wise Public Investment for San Francisco?” that the city could pay for its investment within five years and make $2 million per year thereafter by leasing space on the network. So all sides are happy to see the fiber study finally moving forward.
“We met with a lot of resistance to the study, but the good thing was we got the money for the study from the Mayor’s Office,” Ammiano told the Guardian. “While I’m disappointed that it’s taken so long, I’m heartened that it’s now moving.”
Meanwhile, Google last week got a free citywide wireless system up and running in its native Mountain View. The system is faster than the free service it intends to offer to San Franciscans, who will have to pay a bit more if they want anything faster than the targeted average speed of 300 kilobytes per second.
“Google is putting up a lot of money to make the service free in San Francisco,” Chris Sacca, who is heading up the project for Google, told the Guardian. He estimated that the company has spent over $1 million to develop the San Francisco plan.
While the fiber study will analyze the benefits to the city itself, Sacca said the wireless proposal began with consumer demand. “At Google we start with the end-user problem, then work backward from there.” SFBG

Why is it news when Dean Singleton competes in Eureka, but not news when he works to destroy daily newspaper competition in the Bay Area?

In my first journalism class at the University of Nebraska in Lincoln in the fall of l953, Professor Nathan Blumberg laid out the useful concept of Afghanistanism. This means, he said with gusto, that the press covers the big story in Afghanistan (obviously, times have changed) instead of covering the big local scandal in their own city (obviously, as I am reporting, times have not changed on this score). He spent the rest of the semester outlining local scandals that the local press in many cities was censoring or trivializing. He ended the semester with a rousing rendition of Upton Sinclair’s “The Brass Check,” his bible of the pattern of Afghanistanism in many American newspapers.

To bring the concept up to date, let us take the Sunday Aug. l3 story in the Sunday Magazine of the San Francisco Chronicle click here. It was a long, detailed, colorful story with lots of photos titled “RUMBLE IN THE REDWOODS, What happens when two daily newspapers duke it out in a market known more for its weed than its writing?” It details, way way up in the redwoods, out there by the ocean, up by the Oregon border, a long long way north of San Francisco, that rare example of head-to-head daily newspaper competition. A Dean Singleton/MediaNews group daily (the Eureka Times-Standard) is being forced to compete ferociously with a new upstart daily (the Eureka Reporter) founded by a local financier/tax attorney/banker called Robin P. Arkley II The lead sums up the point of the story: “It is the unlikeliest retail war in the unlikeliest market, a high-stakes game of chicken in a place so offbeat, it is now the setting for a new Sci-Fi Channel show.”

Just as in the old days when there was real daily competition in San Francisco, the publishers and editors and staff take public shots at each other. Arkley is quoted as saying that “I get tired of the Times-Standard saying ‘Rob is trying to put us out of business.’ I mean (the Times Standard and parent Media News) are a monopoly in every market they are in, whining like a bunch of babies…The first lick of competition they get they scream like they are getting (screwed)…They are not having any fun.”

Arkley says he launched the Reporter out of a desire for more local news. “I noticed over the generations the Times-Standard to the ‘Sub-Standard’ to the ‘Daily Disappointment.’ It was not publishing local news…Part of the challenge for local communities today is to keep our local identities. And one of the easiest and most direct ways to do that is with our local newspapers. I felt we needed a local paper again.”

Arkley says he no longer reads the Times-Standard but Singleton says he reads the Reporter, which he derisively calls “a shopper” because it is delivered free to people’s homes. “I watch (the Reporter carefully,” Singleton says in his Rocky Mountain twang (his company is based in Denver). “But when you get right down to it, it is not really a quality newspaper…I think it makes (Arkley) think he is a big man in town. I am not sure buying a printing press and throwing papers around makes you a big man in town, but he thinks it does.”

In short, Joel Davis, a former Times-Standard entertainment and news editor from l988 to l995 and now a Sacramento journalist and college journalism instructor, wrote a nice yarn that inadvertently made a most telling point on the state of journalism in California and the country today.

For Hearst in San Francisco, which finally got what it always wanted in San Francisco (a virtual morning daily monopoly), and for Singleton, who hates competition with a passion and now is moving lockstep with Hearst toward regional monopoly, old-fashioned daily newspaper competition is a slam bang big story—but only if it is up in Eureka. The real story, how Hearst and Singleton are destroying daily competition and imposing even more conservative monopoly journalism on one of the most liberal and civilized regions of the world, is not much of a story at all. It is only a story to be minimized, marginalized, censored, covered in fragments, and buried deep in the business section (See our coverage and our blogs)

The latest example: in Tuesday’s Chronicle, buried on page 2 of the business section, was a “Daily Digest” short under a wimpy little head titled “Foundation among MediaNews backers.” It was an Associated Press story out of Seattle which provided a nugget of new information from an Aug. 8th Securities and Exchange filing. The nugget: that the Bill @ Melinda Gates Foundation had invested an unspecified amount of money in the megaconglomerate deal.

The news was three weeks old. It was published a week after the Contra Costa times ran it. I did a blog on it a week ago. It was written by the Associated Press out of Seattle, not a Chronicle cityside reporter or one of the legion of Chronicle business reporters. The four paragraph story once again amounted to only a fragment of an item that begged for a real comprehensive story. Not once has the Chronicle or any of the papers involved in the deal (Hearst/Singleton/Gannett/Stephens/McClatchy) done the kind of full and complete story, on this unprecedented major local story, and its adverse consequences to their local communities, that they would have done on anybody else. Not once to my knowledge have any of the monopoly publishers or their editors or columnists had a cross word to say publicly about the others or about the march to regional monopoly.
Why?

P.S.: One thing I like about Dean Singleton is that, when a reporter calls him for a quote, he is not afraid to give him some juicy ones.

Perhaps one of the megaconglomerators has done a real story on the real consequences of such consolidation and regional monopoly on their staffs, the health and welfare of their communities, and the competing voices concept underlying the First Amendment and all good journalism. It’s criminal what Congress has done to the working poor

OPINION Congress’s Republican leaders belong in prison. They have openly violated one of our most basic laws, the 68-year-old Fair Labor Standards Act. It requires Congress to set the minimum wage high enough to guarantee a standard of living necessary for health, efficiency, and general well-being.
The current rate of $5.15 an hour comes nowhere near to doing that. Even those who manage to work full-time make only $10,700 a year – $206 a week or about $900 a month, minus taxes and other deductions. They and the 15 million other Americans who are paid at or near the minimum – more than one-third of them provide the main or sole support for their families – are by any reckoning poverty-stricken and barely surviving.
The law allows states and local governments to adopt minimum-wage rates higher than the federal rate. Although California and 20 other states, San Francisco and 139 other cities and counties, and the District of Columbia have done so, the higher minimums cover only about half of the country’s workers.
Democrats have argued long and hard in the current session of Congress for a higher federal minimum, as they have in every other session since the $5.15 rate was set in 1997. But the Republicans who’ve been running Congress have higher priorities – raising their own pay and cutting the taxes that are such a burden to their wealthy supporters.
Oh yes, the GOP leaders did introduce a bill that would have raised the minimum. But the measure made that contingent on cutting the estate taxes of the very wealthy – a linkage, opposed by even some Republicans, that guaranteed the bill’s defeat.
They’ve raised congressional pay in every session since 1997, while doing nothing for the working poor. That’s added more than $31,000 to the minimum wage of congressional members, currently $165,200, with a $3,300 raise scheduled for Jan. 1. Unlike minimum-wage workers, who rarely have fringe benefits, members of Congress also get free health care, pensions, and other expensive extras.
The minimum wage for ordinary people would have risen to $7.25 an hour over the next two years under the latest Democratic proposal blocked by the GOP’s congressional leaders. Its main proponent, Sen. Edward Kennedy of Massachusetts, promised that the fight to raise the wage “will continue all across America.”
It is certain, in any case, that Democratic candidates will make it an issue in this fall’s election campaigns. They are well aware, certainly, of polls showing that an overwhelming majority of Americans favor a minimum-wage increase.
So why in the world are Republican leaders so adamantly against it?
Because their big-money backers in the restaurant business, who employ about 60 percent of all minimum-wage workers, are against it, as are many other business and corporate interests. The opponents have even formed a group, Coalition for Job Opportunities, to spread the fiction, much favored by the GOP, that a higher minimum would force employers to eliminate jobs.
Actually, the number of jobs has grown after each of the 19 times the minimum has been raised since it was initially set at 25 cents an hour in 1938.
The job growth has been spurred primarily by the increased spending of those whose pay has increased. Like all low-wage workers, they must spend virtually every cent they earn, thus raising the overall demand for goods and services and creating the need for new employees.
Think of the general benefits to society if the minimum-wage workers who now must depend on government assistance could earn enough to make it on their own.
Think of the benefits to employers. As several studies have shown, raising workers’ pay raises workers’ morale and, with it, their productivity, while decreasing absenteeism and recruiting and training costs.
Think of the benefits to small retailers. Opponents of a raise say they’d be hurt the most by a higher minimum wage, but it’s far more likely that they’d be among the greatest beneficiaries. For minimum-wage workers have no choice but to spend most of their meager earnings in neighborhood stores for food and other necessities. SFBG

Can Werbach reform Wal-Mart?

EDITORIAL Those with power rarely use it to help the powerless: workers, foreigners, or the planet. That’s why we’re fascinated by the green noises that we’re starting to hear from übercorporation Wal-Mart and with its decision to hire our hometown environmental heavy hitter Adam Werbach, a move that reporter Amanda Witherell explores in this week’s cover story (see “An Unbelievable Truth,” page 15).
We’re skeptical of Wal-Mart’s motives and commitment to putting the planet before profits, so we truly hope that Werbach hasn’t been co-opted into a greenwashing effort. But because of the positive potential in this arrangement, we’re willing to trust Werbach’s judgment. In turn, we urge him to remember his roots and expect him to document his experience inside Wal-Mart and blow the whistle if Wal-Mart isn’t honoring its promises.
Let’s take a minute to look at the timing and potential of this. Wal-Mart is on the ropes even though it’s the undisputed heavyweight champion of the world. The activists and communities that oppose it are banding together like never before. And they’re getting bolder in that opposition, such as when the city of Hercules earlier this year used eminent domain to seize land from Wal-Mart rather than allow a store in its community.
Wal-Mart has also lost some political clout. First it lost its most supportive Democrat when fellow Arkansan Bill Clinton left the White House. The Republican Party it sponsors is also likely to lose ground in the midterm elections, just as the country’s trade deficit hits record levels.
People are also waking up to the fact that Wal-Mart’s poverty-level wages and lack of good health insurance end up being subsidized by taxpayers. And there very well could bubble up a backlash against the kinds of obscene wealth-hording being pushed by Wal-Mart’s Walton family and others, as reporter George Schulz also details in this issue (see “Shackling the Tax Man,” page 11).
Finally, consider two high-profile media moments from this summer that put more pressure on Wal-Mart. The Al Gore film An Inconvenient Truth has succeeded in placing global warming near the top of people’s concerns. This pressing environmental problem is made much worse by Wal-Mart’s practice of importing and distributing goods all over the planet.
The other was a widely circulated essay in the July issue of Harper’s Magazine, “Breaking the Chain,” which made a strong case for the federal government bringing an antitrust action against Wal-Mart and smashing the chain to pieces. The article focused not on the widely discussed environmental and labor arguments, but on how Wal-Mart’s market power and the way it wields it hurts the economy and other businesses because it can dictate terms to all of its suppliers, a concept known as monopsony power.
So we all have good reason to believe that Wal-Mart executives and their newfound concerns for the people and the planet aren’t just motivated by altruism. And this corporation has a long way to go before anyone should believe its executives intend to transform it into a force for good. We simply don’t trust Wal-Mart and don’t think anyone else should either.
Ah, but what if? That’s the question that will cause us to hold our fire for now and watch to see whether Wal-Mart’s actions follow its rhetoric. Given Wal-Mart’s monopsony power over suppliers and near monopoly power over consumers, this corporation has the power to force substantial changes in the wasteful and overly consumptive habits of the average American. The potential here is phenomenal.
Is Werbach the guy to help them realize that potential? Maybe. He’s been an inspiring and effective crusader for economic and social justice for most of his life, which is why we were thrilled when Sup. Chris Daly snuck him onto the San Francisco Public Utilities Commission.
But in that role, he hasn’t been the bold visionary that we’d hoped for. Community Choice Aggregation, that baby step toward public power, moved way too slowly and didn’t go far enough, largely because Werbach failed to lead. And the movement for real public power has long been stalled, even on a commission that should be focused on kicking Pacific Gas and Electric out of San Francisco, although we’re pleased by the latest sign of life: the SFPUC is trying to offer public power from renewable sources on the former Hunters Point Naval Shipyard property (see “Public Power Play,” page 10).
Werbach needs to be a forceful and uncompromising advocate for Wal-Mart to radically change its business model, and if he hits serious roadblocks, he must be willing to quit and talk about his experience with the Guardian or another publication, no matter what the personal cost. SFBG

“There are few things in the world as pleasurable as taking a nap on a chamomile patch,” says herbalist Joshua Muscat. “It’s an herb that doesn’t get a lot of respect. It smells good. It looks good. The flower is cute.”
It’s a hot Sunday morning in west Berkeley, and Muscat is leading a workshop called Local Medicinal Herbs and Your Health. This session is one of the classes offered by the EcoHouse, a unique residence designed to demonstrate sustainable building and gardening techniques. Wearing a white T-shirt, maroon pantaloons, and Crocs, Muscat has a down-to-earth demeanor and a boundless gusto for herbs. He’s been a student and practitioner of Western herbal medicine for the past 11 years, and his five-hour class covers everything from harvesting herbs to practicing holistic health care to preparing medicinal tinctures.
Twelve students gather on stumps, benches, and stones in the EcoHouse’s invitingly rambunctious garden. We’re here for a variety of reasons. Several people express dissatisfaction with mainstream medicine, while others want to enhance their home gardens by adding beneficent native herbs. One man is preparing for a stint at a Buddhist monastery by planting an organic garden. Another says he’s here simply because “the EcoHouse is always inspiring to me. I just like to come here and get a little bit of that.”
Babeck Tondre, a permaculture activist and resident of the EcoHouse since its inception, acquaints us with some of the special features of the site. Native plants and edible species grow in garden beds and containers in the ample yard. Bamboo shoots and ginger plants stretch into the air, towering leafily over the flowering parsnip and varietal poppies. A bathtub fountain burbles peacefully beside a straw bale toolshed designed by a local landscape architect.
There’s a rustle in the yard and a wiry man with glasses and an outdoorsy look rushes up to Muscat, trailing a freshly plucked specimen of the herb of the hour. As we pass the chamomile around, Paul Johnsen dives back into the foliage to search for another plant. Johnsen knows the garden well. A horticulturist, he became a part of the three-person EcoHouse-hold last year and works with Tondre to continually upgrade the site. Almost everything in the garden has a teaching function, including hand-built structures and animal life, which are part of the garden’s ecosystem. The toolshed roof will be renovated during an upcoming workshop on planting a living roof garden. Even the ducks will have their day.
Frances and Nate are brother drakes who waddle about the yard quacking amicably at passers-by on the long stretch of sidewalk that borders the garden’s west-side fence. Parents and children greet the two birds by name. In addition to winning the Mr. and Mr. congeniality award, the ducks keep the slug and snail population to a minimum. This month Frances and Nate will star in a workshop about raising ducks and chickens in your yard. Omelet aficionados have doubtless already sniffed out another potential benefit of raising female fowl: harvesting eggs. The EcoHouse did, at one point, foster a female duck, who purportedly laid large and delicious eggs throughout the yard. She died, though, so there won’t be eggs in the garden until the mail-order chicks arrive.
But other organic edibles abound, and during the lunch break Tondre encourages us to “forage in the yard.” There are low-water apple trees that yield a tart, green fruit and quince trees and raspberry bushes. Someone passes a basket of freshly picked gooseberries around the class. Their papery sheathes enclose a berry the size of a cherry tomato, and the intensity of the sharp, sweet flavor is akin to having a pellet of freshly cut grass applied directly to the taste buds.
Refreshed by garden goodies, we’re ready for more learning. Muscat talks about the importance of harvesting herbs responsibly. As medicinal plants such as echinacea and goldenseal gain widespread recognition and use, wild sources can suffer from overharvesting. Muscat recommends patronizing small businesses such as Lhasa Kharnak in Berkeley (www.herb-inc.com) or Scarlet Sage in San Francisco (www.scarletsageherb.com), which utilize sustainably grown or harvested plants. A group called United Plant Savers (www.unitedplantsavers.org), dedicated to preserving native medicinal herbs in North America, provides a list of endangered herbs, as well as one of responsible plant purveyors.
The best way to ensure a good source is to grow herbs in your own garden. Since space is a limiting factor for many of us, Muscat encourages urban gardeners to think collectively when deciding what to plant. As in, I’ll grow yarrow in my container garden if you grow lemon balm in your window box.
Devising tactics and sharing resources like this is a primary goal of the EcoHouse, according to Tondre. “Karl would want me to say how this project fits into the larger community,” Tondre says. The Karl he’s referring to is the late Karl Linn, a community activist and landscape architect who spearheaded the EcoHouse project in 1999. Though Linn passed away last year, his vision and presence remain vividly felt here.
Classes at EcoHouse are $15 and no one’s turned away for lack of funds. Expanding its community reach and resources, the EcoHouse recently joined forces with the Ecology Center, a well-known Berkeley nonprofit that offers a wealth of green resources to compliment the action-packed EcoHouse workshops. The center acts as an umbrella organization that hooks green-minded volunteers up to relevant activist organizations and also operates an information desk that answers such practical questions as “Where can I get worms for my worm bin?” The center also houses the Bay Area Seed Interchange Library (BASIL), which offers seeds for free; the price tag is a promise to bring seeds back to the library the following year. Beck Cowles, program director at the Ecology Center, speaks enthusiastically about the partnership with EcoHouse. “One of the neat things is that because it’s a demonstration site, people are able to come and get hands-on experience in learning to live more sustainably in the city.”
Back to the herbal-medicinal course at hand: just spending time in the garden will help fix what ails you, Muscat says. He opposes the quick-fix, pill-happy culture of mainstream medicine. Muscat advocates for Western herbal medicine as an alternative or compliment to mainstream medical practices. “It just doesn’t work within a capitalist framework,” he says. While herbal applications can remedy certain short-term problems (lemon balm: great for soothing herpes sores!), Muscat says that his holistic approach is more effective in treating long-term ailments, such as chronic fatigue and sinus allergies. Putting his mugwort where his mouth is, Muscat runs the San Francisco Botanical Medicine Clinic (www.sfbmc.org), an organization that provides low-cost treatment using herbal remedies and a holistic approach to health care.
After several sun-beaten hours among the plants, our fog-accustomed bodies are responding with proto–heat stroke. So Muscat pitches a canopy and retires to the dappled shade of a prune tree to gleefully demonstrate the mad-scientist-meets-celebrity-chef aspect of herbal medicine: preparing tinctures. His working surface is made up of a warped wooden table, upon which rest a heavy-duty blender, two quart-size bottles of Everclear, and an “I [Heart] My Guru” mug.
As Muscat blends, sifts, measures, and shakes, I inadvertently engage in the ancient practice of urtication, otherwise known as flogging with nettles, as I brush against a prolific member of the genus Urtica growing next to my stump seat. For a moment I ponder seizing the bull by the horns or, um, the nettle by the hair?, and continuing the flagellation. Relieving rheumatism, after all, is one possible application of the plant’s medicinal properties, according to herbalists.
And those who find pleasure in pain (including certain members of the kink community and perhaps of Opus Dei) are well acquainted with the nettle’s saucy sting. It’s just one more example of symbiosis between people and plants. It turns out that plants too can thrive on a bit of rough play. As Shakespeare penned in Henry VI, “The Camomile; the more it is trodden on, the faster it grows.” SFBG

Fixin’ to ride

Lately, I’ve been feeling like a gearhead dilettante. The realization that there is indeed a gap between acquired knowledge and wild conjecture has been nagging me — particularly in regards to my beloved bicycle. Said beloved bicycle, once such a pleasure to ride, has recently taken to dragging its vulcanized heels every time we start up Potrero Hill, gasping, “I think I can’t, I think I can’t.” Does the problem lie with my bearings, my rims, my gears, my chain? Should I have been filling my tires more than once every six months? Do I need to invest in a Shimano 105 RD-5501 Triple Rear Derailleur? (Full disclosure, I don’t actually know what that is.) I’m embarrassed to turn up at a bike shop and admit that although I once traversed the pays Tamberma of northern Togo on a single-speed clunker, I can’t even fix my own flat. And frankly, judging from the way I’ve seen some of you court death with your squealing brakes and your red blinkies in the front, I don’t think I’m the only bike enthusiast in San Francisco lacking the fundamentals.
Question is: where can we go to gain some mad cycle skills of our own?
I naturally begin my search with the San Francisco Bicycle Coalition. Andy Thornley, the boundlessly encouraging SFBC program director, provides me with a list of fix-it-yourself resources that astounds me with its paucity. I’d rather expected that a city with as flamboyantly visible a bike culture as San Francisco would have a greater emphasis on the DIY. But a little list is still a list worth checking out, especially if it promises to save me some coins and squeals.
Thornley also clues me in that although SFBC doesn’t offer anything in the way of bike maintenance, it does give a free 10-hour, 2-day course on road safety for urban cyclists of all levels. The course, certified by the League of American Bicyclists, includes instruction on “riding in traffic, necessary equipment, crash avoidance, and legal rights and responsibilities.” He recommends registering for the class online, where it’s also possible to sign up for weekly e-mail updates on events, bike-related news, and volunteer opportunities.
On to my FYI FIY list. First stop: the Freewheel, a Western Addition fixture since 1978. The current course instructor, Wayne Brock, ushers me into what was once a health food and hardware co-op, and points out some of the amenities of the community workshop: four bike stands in the center of the room (plus two others for classes against the wall), a big blue solvent tank, a wheel-trueing stand, and a wall of shop-quality tools. A row of new hybrid cycles lines the far wall, but the emphasis here, unlike at the Freewheel branch on Valencia Street, is less on retail than on repair and custom building. Brock, 31, is a science teacher by day and actually acquired his own basic skills at Freewheel eight years ago.
“The curriculum has been ironed out over a long period of time,” he says. “Really boiled down to the essentials that will get you going.” These essentials, taught over two four-hour sessions, begin with flat repair, then continue with wheel-trueing, brake adjustments, hub overhaul, crank removal, drive train cleaning, chain maintenance, and derailleur adjustments. Already I’m a little overwhelmed. Which part is the crank? Fortunately for class participants, a take-home cheat sheet covering all of the above is provided and the $100 course fee includes a six-month Freewheel membership, with unlimited access to the community work space and tools during regular business hours.
One former student I talked to praises the Freewheel technique for “demystifying” the bicycle for her, though she admits to not availing herself of the membership benefits. She does, however, keep her bike much cleaner and better-lubed than before and feels more able to perform minor repairs on her own. Classes, generally held on Mondays, are limited to six students, and an absolutely nonrefundable $50 deposit guards against no-shows. To get on the waiting list, it’s best to go directly to the shop, deposit in hand. Your bike should already be in good repair, since the object of the course is familiarization, not parts replacement. Still, with complete in-store tune-ups going for $120, the value of a class that gets you even partway there seems like a good deal.
Over at San Francisco Cyclery in the Upper Haight, shop owner Heather Bixler, herself a former Freewheel instructor, is pioneering a schedule of classes with an emphasis on specialization. After a free class in basic maintenance, participants have the option to take one or all of a series of successive one-hour, $15 classes focusing on one component at a time: brakes, shifters, bearings, and wheels. Sometimes an additional class in roadside repair is offered, and graduates of all of the above may take a final class in complete tune-ups. Not coincidentally, the Cyclery’s female-facilitated workshops attract many women, though the classes are open to everyone. The emphasis is “to really get your hands dirty,” Bixler says, though, as with Freewheel, your cycle should be in working order prior to the course. Classes range in size from five to six people and are normally held on Wednesdays or Thursdays. A $15 deposit is required to hold your space (except for the free class), and booking is best done over the phone.
While Pedal Revolution in the Mission District has a community membership workbench plus occasional free seminars on a variety of repair topics, the nearby Bike Kitchen offers sliding-scale courses with a bit more regularity. I drop in on a wheel-building class ($30–$60 plus parts purchase) and watch as five newly threaded wheels are tried and trued. Instructor Brian Cavagnolo circulates while his students, including a former bike messenger and an editorial intern from a local luxury magazine, squint intently at their trueing stands, spinning their wheels. I’ve been frustrated by the Bike Kitchen in the past when trying to get on the repair class waiting list, but Cavagnolo seems optimistic that this will be less of an issue after its big move from the Mission Village Market to Mission at Ninth Street. (The grand opening is Aug. 19.)
“It’s a smaller space,” explains Cavagnolo. “So we’re going to have to be more organized.” Due to be streamlined is the build-a-bike program, which allows one to earn bike parts through volunteer labor and use Bike Kitchen tools to construct a working two-wheeler. In 2005, the volunteer-run Bike Kitchen was awarded a San Francisco Bicycle Coalition Golden Wheel award for its contributions to bicycle culture in the city, and the newbie wheel builders seem pleased with the experience they’re gaining.
“I took a wheel-building class [in Berkeley],” the magazine intern says, “and it was totally useless. I watched a guy build a wheel.” He rotates his self-made wheel with satisfaction. It hisses against the fork of the wheel-tuning stand as he reaches over to tighten another spoke. Cavagnolo recommends keeping abreast of class schedules via the SFBC newsletter or by visiting the Bike Kitchen Web site and e-mailing info@bikekitchen.org to get on the waiting list.
My survey at an end, I ride my still-recalcitrant yet soon-to-be-purring steed home, my head spinning like a newly tuned wheel. I stop by Needles and Pens and pick up “A Rough Guide to Bicycle Maintenance,” a slim but informative bike zine compiled in Portland. With clearly labeled diagrams of various bike parts, some simple repair methods, and the tools I’ll need to get started, I already feel one step closer to bicycle demystification. Now all I have to do is sign up for my first repair class … and you folks with those screeching brakes and front-mounted red blinkies should probably consider doing the same. SFBG

Bad social failures eventually come back to haunt you. That’s what’s happening in the California prison system, where decades of lock-’em-up legislation, stupid drug laws, and governors who are terrified of the political consequences of paroling inmates have filled the jails with aging prisoners who require extensive medical care. Tens of thousands of people will die in state prisons in the next few years, not of murder or abuse but because they’re serving life sentences — and it’s going to cost a fortune to take care of them in their declining years. The state may have to set up special geriatric cell blocks and hospital wards for inmates who did something pretty bad a long, long time ago and never got another chance at life.
And so it is, apparently, with San Francisco’s homeless population.
According to a new study by the University of California, San Francisco, the median age of the city’s homeless people has gone from 37 in 1990 to about 50 today. The thousands of people who live on the streets are getting older and older — and their health is failing. Many of them, it seems, have been there at least off and on since the 1980s, when the federal government under Ronald Reagan stopped spending money to help cities provide low-cost housing.
If the study, reported in the Chronicle on Aug. 4, is accurate, there are some important policy conclusions that we need to be looking at. For starters, it suggests that many of the homeless people in San Francisco are not arriving here because of friendly programs and attitudes; we are not a “magnet” for the homeless. In fact, the people living on the streets are … San Franciscans. Some have been living here as long as I have. They are part of our community, part of our city. They just don’t have a roof over their heads or a place to go and shut out the world.
Then there’s the fact that harsh cutbacks in spending on low-income populations only create more, and more intractable, problems. The aging homeless are going to need a lot more expensive medical care over the next few years, and the only way they’re going to get it is at taxpayer expense. By the time the baby boomer generation of homeless people has died, I bet San Francisco will have spent so much money on caring for them in their later years that it would have been cheaper to just give them all a decent welfare payment, health insurance, and a decent place to live.
Building housing is expensive. Building so-called supportive housing — residential units with social services on-site — is more expensive. Treating people in hospitals who are literally dying of homelessness is even more expensive than that.
You want to be a cold-eyed conservative? The cheapest solution is to radically raise the general assistance payment to the point where homeless people can afford an apartment. That also happens to be the most humane.
Once upon a time, what a lot of homeless people needed was cash, not care. Cash, not care. Now they need care — and the people who elected Gavin Newsom and who complain about the homeless are going to be paying for that care. SFBG

Dear Andrea:
My sister introduced me to one of her best friends. She’s a wonderful girl, smart and tough and funny and cute and accomplished. She’s traveled the world and is a field biologist. She’s exactly the kind of woman I dream of.
On our second date, if you can call it that, we spent nearly four days straight together. The more we’re together, the more we want to be together. So here’s the rub. One night my sis and I were talking about herpes, and she told me that this girl once had a genital fever blister. She also said (she’s a biologist too) that she had 95 percent confidence in the information.
Now clearly I can’t betray my sister’s confidence by just blurting out some blunt question, and I don’t much care for games. So I’ve offered to get tested and intimated that I would like her to as well. You know, as a way to let the evidence speak for itself, and nobody gets hurt. She demurred and said something like, “What for? We’ve already pretty much taken our chances.”
What do I do? I know my chances of picking herpes up without her being broken out are somewhat less than 10 percent, so I’m kind of playing the numbers right now, but I think she should have already been honest with me. Don’t you? I mean, that’s what a real relationship is founded on. And I do have to admit that it kind of nags at me, in the back of my head, but I’ve let it go now for three or four wonderful, adventurous weekends spent in and out of bed and in and out of all kinds of different sex positions. What’s to be done? I like her a lot. How do I keep the romance alive and figure out what I might be picking up all at the same time?

What Good Can Come of This?
Dear What:
You have no idea what you could be picking up, and neither, to be fair, does she. As many as 75 percent of people infected with HSV (herpes simplex virus) are asymptomatic or oblivious, so what makes you so special? You could have been infected for years and been merrily spreading it from blossom to blossom like a busy little bee, all unawares. Anybody could.
While I think many AIDS educators go way overboard insisting that everyone is equally at risk and every new contact should be assumed positive until proved otherwise, it’s surely true of herpes: Anyone could have it, and most of us do. I have no idea, for instance, whether I’m immune (I’ve never had the slightest hint of a cold sore or anything suspicious down there) or am simply another asymptomatic shedder, merrily spreading, et cetera.
Herpes is usually tested for with a swab at the site, but there are blood tests available for the asymptomatic and curious (the American Social Health Association, at www.ashastd.org, has all the information). Hardly anyone gets them, though — they’re expensive and inconvenient, and most people never even think about herpes unless they know they’ve been exposed or have developed symptoms. And I don’t blame them. What could be more “out of sight, out of mind” than something you’ve never seen and would rather not think about?
All this aside, a “genital fever blister” like your lady friend reputedly had that one time almost certainly counts as a symptom. While there are herpes-ish things that can pop up in or around the mouth — canker sores, pizza mouth — a blistery lesion on the genitals is overwhelmingly likely to be the real thing. (Of course, she added cheerfully, it could have been syphilis!)
It’s pretty common to have one outbreak and never have another, although as I’m sure you know, the herpes is not gone nor should it be forgotten. It is merely hiding. And an infection tends to get less virulent over time and is harder to spread from female to male (that 10 percent figure you quoted probably referred to transmission from male to female and to monogamous non-safe-sex-having couples over the course of a year, not a three-day one-night stand), though you could, I suppose, have been unlucky. In the absence of suddenly appearing sores, you’ll probably never know. Now what do you want to do about it?
Assuming the lady ever even had that outbreak (hey, my brother’s a biologist too; he’s way smart, but I defer to him on matters of marine ecology, not who’s had which kind of cooties and when), she did owe it to you to fess up. This does not absolve you from failing to think about, ask about, or take responsibility for avoiding infection yourself, though, does it? It takes two to tango, tangle, or transmit, after all.
If you don’t like games, don’t “intimate” things — ask them. If you want to know if you got infected, get a blood test. If you want the girl, call her. I don’t see where any of these are mutually exclusive.

The Mayor’s Office of Communications has for months been fighting with Sup. Chris Daly and several unrelated activists over the release of public documents. By denying and ignoring Sunshine Ordinance requests — including some by the Guardian — the office has garnered a reputation for secrecy that has transformed a disparate group of activists into a united force pushing the boundaries of the city’s landmark open government law.
The Sunshine Ordinance Task Force (SOTF) on July 25 found the MOC in violation of the Sunshine Ordinance on two counts, but the mayor’s spokespeople defied its decision and refused to release seven pages of MOC e-mails that Daly requested. Jennifer Petrucione, who spoke for the mayor at the meeting and left before a final decision had been reached on one of the violations, told the Guardian, “I was contemptuous of the process.”
Her view and that of mayoral press secretary Peter Ragone, as they explained to the Guardian, is that the voluminous nature of some requests and the political motivations of document requesters like Daly violate the spirit of the Sunshine Ordinance, which voters passed in 1993 to encourage public access to how decisions are made in city hall. Instead of disclosing documents, the MOC has found loopholes in the broadly written law permitting them to hide information.
“We have the right to withhold certain documents if they are recommendations,” Petrucione told us July 28, even though the task force generally supports disclosure of such documents. In another case of ignoring a request, she chalked it up to an accident: “That was not us trying to avoid Sunshine, it was us doing it too quickly and overlooking things.”
While both Ragone and Petrucione insisted it’s their policy to release everything they can, even if it’s logistically difficult given the volume of requests they receive, they’re still having a hard time producing documents in a timely fashion. So some activists have reacted to early inaction with ever more voluminous and complicated requests.
The day after we discussed the MOC Sunshine Ordinance policies with Petrucione and Ragone, Mayor Gavin Newsom appeared at a town hall meeting in the Richmond, where we asked him about the dispute with Daly’s office. “I haven’t been privy to the details,” he told us. “I would like to see us readily provide whatever information is being requested. I said, ‘Peter, just send all the information, even in the spirit of the ordinance. We have nothing to hide.’”
Two days later, Petrucione called the Guardian to say the mayor had ordered her office to release the disputed documents after all. She told us, “You guys want to make an issue of it, so we decided to just put them out there.”
BURIED DOCUMENTS
The disputed e-mails requested by Sup. Daly involve Ragone’s purchase last year of a tenancy in common (TIC) from which two disabled residents had been evicted by a landlord evoking the Ellis Act, as first reported by the blog www.beyondchron.org.
Daly was curious if there might be any connection between Ragone’s new digs and Newsom’s vetoes of proposals that would have protected tenants from those kinds of evictions. Daly’s office filed an immediate disclosure request for any documents regarding evictions or condominium conversions.
After the MOC initially responded that they didn’t have any such documents, which Daly’s office didn’t believe, the issue dragged out over four months in front of the SOTF, with the MOC eventually turning over about 25 relevant documents but withholding seven e-mails, with Petrucione citing Section 67.24 of the Sunshine Ordinance: “Only the recommendation of the author may, in such circumstances, be withheld as exempt.”
Daly appeared at the meeting to speak on his own behalf. “I’m not attempting to have a gotcha on the Mayor’s Office. I’m attempting to form a decision,” he said.
The task force doesn’t have the power of subpoena or investigative authority — its members can’t look at the e-mails and decide if they’re public — so the matter was referred to the Ethics Commission, which does. Petrucione, who had the documents at the meeting, could have just handed them to Daly. She told the Guardian, “We’re not concerned about what the e-mails say. We’re trying to adhere to the letter and the spirit of the law.”
In fact, the documents contained only mildly embarrassing information, with a pair of e-mails from Petrucione plotting ways to overshadow the news of Newsom’s tenant protection veto last September by releasing word of the veto late on a Friday and coupling it with a high-profile announcement of San Francisco’s Hurricane Katrina relief efforts, “which will bury any interest in the Ellis release.”
But the MOC’s resistance to disclosure — both to Daly and to activists also seeking information during that same time period — has only served to galvanize those seeking public records.
ACTIVISTS’ SUNRISE
Everyone starts with a little kernel of concern, a reason to wonder or worry about what those elected officials are up to. Kimo Crossman last year wanted to know more about the sketchy municipal wi-fi deal with Google and Earthlink that Newsom was proposing. After hitting initial roadblocks when making requests for specific information like a copy of the contract, Crossman started asking for reams of documents, anything remotely related to the TechConnect plan. His concerns have now expanded to disaster preparedness issues and finally to the Sunshine Ordinance itself.
Last week at the SOTF meeting, where Crossman is now a regular member of the audience, he filed a complaint that the mayor had not provided the opportunity for public comment at a Disaster Council meeting June 5. After reviewing video and transcripts of the meeting and hearing Petrucione’s evolving explanations, the task force found a violation.
Crossman — who at one time was being considered for “vexatious litigant” status by city officials who wanted to tone down his voluminous requests — was pleased and said, “I thought it was a success that the mayor was held accountable to Sunshine just like everyone else in the city.”
Perhaps the violation will inspire the Mayor’s Office to fulfill the outstanding records requests of other citizens, like Wayne Lanier, who had a little home improvement issue.
About a year ago, Lanier and a few of his neighbors repaired the sidewalk around a few trees and planted some flowerpots in front of their homes. Then the city slapped them with a $700 tax, under the Occupancy Assessment Fee for Various Encroachments.
The ordinance was introduced by the mayor and passed the Board of Supervisors in July 2005. It was designed to tax property owners who eat up the public right-of-way with stairways and fences, but the ordinance became what Lanier likes to call the “tree and beauty tax.”
Lanier wanted to know what kinds of meetings and discussions had led up to this ordinance, so in March he sent a Sunshine Ordinance request to Newsom. “I requested his calendar prior to July,” Lanier told the Guardian. “A very simple e-mail request under the Sunshine act.”
Lanier says he has yet to receive an answer to his request, let alone any correspondence or acknowledgement from the Mayor’s Office that they’re working on it. Later, he had concerns about avian flu, where he was again rebuffed in his attempt to get documents.
THE PRICE OF DELAY
The frustrating stories of Crossman and Lanier eventually caught the interest of Christian Holmer, who championed their causes and set out with Crossman on a project they think could streamline the practice of releasing public documents.
Holmer is the secretary of the Panhandle Residents Organization Stanyan Fulton, which has a Web site compendium of all the Sunshine Ordinance requests he knows about. He posts a running countdown of how many days each request has been outstanding, as well as details on the runaround and excuses he receives from city officials.
His goal is to standardize how various departments produce documents and make them more easily accessible to the public “in as few keystrokes as possible,” as he puts it. And to do that, he’s made lots of Sunshine Ordinance requests, which MOC officials argue are too onerous for them to deal with, particularly given Holmer’s lengthy, heavily annotated e-mails, which he fires off to a variety of city departments on a daily basis.
As the many city reps who receive these e-mails will attest, it can take well over an hour to read the entire contents of one e-mail, only to find out it includes enough attachments to keep the reader busy for the better part of a day.
Petrucione and Ragone, who have received Holmer’s request for the mayor’s daily calendar but not yet answered it, cite the difficulty in figuring out exactly what Holmer wants. However, even the Guardian’s simply worded requests for that same information, as well as documents related to the recent health care measure, weren’t filled by the timelines set out by the ordinance.
Ragone says his office is just trying to keep up with the deluge of document requests. He raised the possibility of reforms, such as a designated Sunshine Ordinance officer or standardized form, but the MOC hasn’t formally proposed any.
Matt Dorsey of the City Attorney’s Office is wary of standardizing the system: “I don’t think the law should create a barrier — a ‘you didn’t sign this so I don’t have to answer it’ situation.” SFBG

Lebanon calling

About 300 people gathered in front of Sen. Diane Feinstein’s office in downtown San Francisco on July 27 to protest her support for what they — and the citizens of most countries around the world — criticize as unjustified aggression by the Israeli military against Lebanese civilians.
Organizers with the recently formed Break the Siege Coalition had Lebanese and Palestinian experts and eyewitnesses on the telephone lines, hoping to broadcast them to protesters over a sound system, but they were prevented by technical difficulties.
Instead, after listening to a series of speakers — including Todd Chretien, a Green Party candidate challenging Feinstein, and Krissy Keefer, another Green who’s vying for Nancy Pelosi’s congressional seat — demonstrators marched to Union Square and then the Chronicle — whose coverage the protesters criticize as biased toward Israel. Eight were arrested there for blocking traffic.
Paralleling the organizers’ efforts, the Guardian reached out to civilians still in Lebanon to get unfiltered perspectives directly from the ground. What we encountered was profound outrage and unprecedented support for Hezbollah. They say the international community has turned its back on them again.
“The level of destruction is incomprehensible,” said Ghassan Mankarem, a pro-democracy and LGBT rights activist experienced in humanitarian relief efforts who is now volunteering with the grassroots Sanayeh Relief Centre in Beirut. “What’s happening here is a systematic act of ethnic cleansing.”
As of July 30, 620 Lebanese — mostly civilians — had been killed since Israel began its onslaught July 12, according to official Lebanese government figures. That’s 12 Lebanese dead for each Israeli killed by Hezbollah rockets and gunfire.
The number of internal refugees was expected to reach one million before this issue of the Guardian went to print, according to Mankarem. Another 220,000 have fled to neighboring countries. Thousands more are trapped in their homes or nearby shelters, too afraid to flee.
The Israelis “are hitting anything they see,” reported Mankarem, including caravans of fleeing civilians and even “Red Cross ambulances and UN observers.” They’ve bombed the airport, reduced whole neighborhoods to rubble, targeted seaports, destroyed most major highways, and obliterated power plants — in one case causing an oil spill in the Mediterranean Sea that local environmental groups say is the worst ecological disaster in Lebanon’s history.
“On the radio, doctors are warning there is no more medicine, no more water, no more space in the hospitals,” wrote Raida Hatoum, an organizer with Najdeh, a women’s nongovernmental organization that works in Lebanon’s Palestinian refugee camps, in a July 24 e-mail to the Guardian. (Hatoum has no access to a phone). “Burnt and shredded bodies are still on the roads” in southern Lebanon.
The same day Hatoum typed those words, Human Rights Watch condemned Israel for using American “cluster munitions in populated areas.” Aid workers on the ground report seeing evidence that Israel has also been using bombs (again, provided or funded by the United States) containing white phosphorus — a chemical agent that burns through the skin, sometimes to the bone, as well as “vacuum” bombs and “bunker busting” bombs containing depleted uranium.
For the first time since World War I, “there’s a real fear of people dying of hunger,” Mankarem said. Israel has been blocking food and other basic necessities from entering the country and has bombed grain silos as well as Lebanon’s main milk production plant, he said.
While Sanayeh struggles to provide food, water, blankets, and medical care to an ever-growing number of refugees, it’s also scrambling to address the profound trauma suffered by Lebanese children.
“Ten percent of the refugees are under five years old,” Mankarem said, speaking to us by phone from the relief center. “Some of them have seen family members decapitated in front of them. Unfortunately, the position of the United States has been to send more missiles,” while vetoing United Nations Security Council calls for an immediate cease-fire. “People here are looking to the rest of the world and asking, why aren’t they doing anything about this?”
It’s the kind of scenario that gave rise to Hezbollah in the first place. And today it’s resulting in a widespread surge of support for the group. A whopping 87 percent of Lebanese — including, significantly, 80 percent of the Christians and Druze — support the resistance to Israel (synonymous with Hezbollah), according to a nationwide poll conducted by the Beirut Center for Research and Information. And that was before an Israeli bomb killed more than 60 civilians — including 37 children — as they slept in a bomb shelter in Qana.
“Had Israel not invaded Lebanon in 1982, there would be no Hezbollah,” said academic Rania Masri, a blogger and regular contributor to www.electroniclebanon.net. “Had the international community enforced UN resolution 425 [demanding Israeli withdrawal from Lebanon], there’d be no Hezbollah. Had the international community [acted more decisively during] Israel’s massive assaults on Lebanon in 1993 and 1996, there would be no Hezbollah…. This is the history that people need to understand. It didn’t begin on July 12 with Hezbollah’s capture of the two Israeli soldiers.”
Another fact not widely understood in the United States is that Hezbollah isn’t simply a militia or terrorist group: in many impoverished, largely Shiite areas — particularly in southern Lebanon and in the eastern Lebanese Bekaa valley — Hezbollah has provided schools, health care, and basic necessities where the central government failed to do so.
Secretary of State Condoleezza Rice tried to draw clear distinctions between Hezbollah and Lebanon’s “legitimate” government early in the conflict. But Hezbollah members are part of that government, and the two entities have each sought a cease-fire that the United States and Israel have rejected, claiming that Hezbollah must disarm.
“We get lectured all the time about democracy,” Mankarem said. “But whenever we make a democratic choice, we get punished.”
Many Lebanese insist they too have the right to defend themselves. And they view American collaboration as the result of a deep-seated racism that presumes that Arabs simply aren’t as valuable as Israelis.
Regardless of the reasons for the assault, one thing is certain: it is resulting in a sharp spike in anti-Israeli and anti-American sentiment, which isn’t making either country safer.
“Even if Israel and the US were to kill every member of Hezbollah, there’d be people to replace them,” Masri warned. “You cannot stop a movement for liberation.” SFBG

Earlier this week I dropped by Christopher’s Books on Potrero Hill, my favorite neighborhood bookstore, and was delighted to find a new grassroots newspaper that is published, written, edited, and distributed by a l3-year-old young lady.

Oona Robertson calls her paper “The hill, a Potrero Hill Kids newspaper.” She writes that she has “lived on Potrero Hill all my life. I like to read, write, fence, play sports and be in nature. I live with my mom, dad, sister, brother, fish and cats. I hope you enjoy my newspaper.”

She says her paper is “for kids of all ages.” The current issue has a poem titled
”Ode to my cat,” an essay headlined “The benefits of not owning a car,” part two of a serial about l5-year-old kids spying on a rich man in a mansion in Napa, four “fun summer recipes,” a synopsis of two kids movies (“Cars” and “Garfield, a Tale of Two Kitties”), a review of “The Alex Rider series,” a “Corn Cake Monster” comic strip, advice for bored kids during the summer (“try the ultimate water fight: invite all your friends and kids from your block to come to your house for the ultimate water fight…bring water balloons, water guns, water bottles, buckets, soakers, anything they can think of…Then go into your backyard or out front and either organize teams or have a free for all.”

The monthly paper is sold for $l at Christopher’s Books, but Oona says for an extra $3 she will hand-deliver her paper, but only to the houses of Potrero Hill kids. She will also take ads for $l. The hill is an amazing bit of entrepreneurial journalism, which I was reading as an email came in from my source in Contra Costa County, a news junkie and First Amendment warrior, who regularly alerts me to news in the Contra Costa Times that doesn’t appear in the San Francisco Chronicle. Did you see that the judge is going against Clint Reilly on his antitrust suit, he asked. No, I replied, I didn’t see the story. So I checked and sure enough, buried on page 9 in the Bay Area section, with a wimpy little head “Early ruling denies bid to halt big media sale,” was a story in the classic Chronicle tradition of minimalist and pock-holed media and power structure reporting. For attentive Guardian readers, you know our competitive-paper line. But this story had major whoppers and raised in 96 point Tempo Bold a new flurry of unanswered questions about a media monopoly move that will (a) allow Denver billionaire Dean Singleton to buy the Contra Costa Times, San Jose Mercury-News and Monterey Herald, plus a batch of weeklies and free dailies, and pile them up in his existing stable of papers that ring the bay, and (b) thereby gain a chokehold on Bay Area journalism for the duration, and (c) destroy the last remaining daily competition in the Bay Area–with the Chronicle– by getting Chronicle owner Hearst to assist and invest in the deal with undisclosed multi-million dollar stakes in other Singleton properties outside the Bay Area.

Whopper No. l: “In issuing the preliminary ruling (against Riley and for the Hearst/Singleton consortium), U.S. District Judge Susan Illston said the defendants faced greater harm than Riley if the sale of the San Jose Mercury News and Contra Costa Times was halted. ’I don’t see imminent irreparable harm to the plaintiffs,’ she said.”

Whopper No. 2: “Alan Marx, an attorney for MediaNews (Singleton), said there will be no cooperation between Hearst and MediaNews after the transaction. He said serious delays to the sale could force MediaNews to incur interest rate penalties of at least $22 million on loans that MediaNews has arranged to finance the purchase.”

Pow! Pow! Pow! If this single ownership chokehold on the Bay Area is not “irreparable damage,” then what is? Why is the federal judge worried about “irreparable damage” to billionaires in New York (Hearst) and Denver (Singleton), as well as the other billionaire partners to the deal in Sacramento (McClatchy) and MClean, Va. (Gannett) and Las Vegas (Stephens), and not worried about “irreparable damage” to the public, to readers, to advertisers, to competitive papers, to the health and welfare of their local communities, and to the marketplace of ideas principle underlying the First Amendment?

Some other key questions that the Chronicle and the other participants in the deal aren’t raising and answering: How can the publishers proceed before the Justice Department and the Attorney Generals approve and sign off on the deal? Why don’t they ask Attorney General Bill Lockyer about the status of his investigation? Lockyer, after all, is running for state treasurer and is on the campaign trail, as is Oakland Mayor Jerry Brown, who is running for Attorney General. Lockyer appeared on the Will and Willie show on the Quake last week and left the room, just before Guardian executive editor Tim Redmond came on. Redmond opened up his remarks by saying that he wished he had known Lockyer was on the show, because he would have asked him about his investigation. And then Tim and Will Durst and Willie Brown discussed the impact of the Hearst/Singleton issues in an open and lively way almost never done in the mainstream media. Why are Lockyer and Brown on the lam, and allowed to be on the lam, when they are once again running for major statewide offices? Let me note that they refuse to answer our repeated questions on the deal.

More questions: why, if Hearst and the other publishers feel they can’t cover themselves, don’t they get comments and op ed pieces from journalism or law professors at nearby UC-Berkeley, Cal-State Hayward, Stanford, San Jose State, SF State, USF? Why don’t they check with other independent experts such as Ben Bagdikian of “Media Monopoly” fame, who is living in Berkeley? Why don’t they quote Norman Solomon, a local media critic who writes a nationally syndicated column? Or Jeff Perlstein, executive director of Media Alliance or the Grade the News media reporting operation housed at San Jose State University? Why don’t they quote union representatives at the Chronicle and Merc? Why don’t they quote any one of the six U.S. representatives from the Bay Area that called on Justice and the AG to carefully scrutinize the sale? Why don’t they call on Sup. Ross Mirkarimi, who introduced a local resolution opposing the sale, or any of the other supervisors who approved it unanimously? (Note: the Chronicle refused to run the Mirkarimi resolution even though I personally hand-carried it to the Chronicle City Hall reporters in the City Hall pressroom.) Why is it left to the handful of remaining independent voices to raise these critical questions?

I’m sending these questions to the local publishers, and I’ll let you know what they say.

Hearst has never been much good on local power structure issues (witness its blackout of the PG&E-Raker Act scandal), but things will only get worse when it is comfied and liquored up with Singleton and there is no real daily competition in the Bay Area. The way Hearst and the other billionaire publishers blacked out and minimalized this critical story–a story critical to their future credibility and influence–is a harbinger of the future of journalism in the Bay Area and beyond. Alas. Alas.

I sometimes think that Oona Robertson and the hill can do better.

This is my first blog, so please be kind until I get the hang of it and get safely out of my Royal typewriter past. I have much to say, in a journalism career that started at age 12 on the famous Lyon County Reporter in my hometown of Rock Rapids, Iowa. I wrote a rousing story about catching a trout in the Black Hills on a vacation with my parents. I wrote a column for four years during high school, wrote off and on through the years and even worked a summer as the only reporter on the paper. I learned a couple of key things in the College of Community Journalism in Rock Rapids: that it is important to be accurate, and good spirited, because the locals know the story and read the paper to see if you got it right. And that, when you write about somebody, you write knowing you may seeing them later that day at the Grill Cafe or Brower’s Pool Hall or the golf club.

In Rock Rapids, I always felt I was having an ongoing conversation with the the people in town and on the farms. And, for the past 40 years at the Guardian, I have felt that the Guardian staff and I were conversing with our readers and the people of San Francisco. So now, with the magic of the internet and the blog, I hope to converse even more directly with our readers. Join the conversation. Join the fun. B3

Plouf Mussels 10 ways — need we say more? Plouf knows its turf, and that’s surf. In Sacramento, Washingon D.C., and most of the rest of this country, politicians and the electorate shrink in the face of Chamber of Commerce complaints that some regulation or piece of legislation will hurt the economy and cost jobs. It doesn’t matter that it often isn’t true, or that the benefits outweigh the costs, or that such comments are clearly driven by naked self-interest. The fact is, in this fearful country, it’s a tactic that works over and over again. The boy keeps crying wolf and we keep running for cover.
San Francisco is proving to be different. The living wage law passed a couple years ago has proven to be a huge success with little downside and this summer’s health care mandate is also filling a troubling void left by the much hallowed market. Next comes a measure by those scrappy and effective activists over at Young Workers United: a measure for the fall ballot requiring employers to provide their workers with paid sick days.
The Chamber is already howling — surprise, surprise — but the reality is this measure will be good for both employers and employees, it’s almost sure to pass, and it will help boost progressive voting power this November.

My love for baseball dates all the way back to childhood, when my dad used to let me stay up past the seventh to watch the Sox on TV. Once a year we made a pilgramage to Boston, where my family dominated a whole row of seating in the nosebleed section, and I got to drink a soda and eat a hot dog and watch my hero, Roger Clemens, pitch from his own mound. Yesterday, for the first time in my life, I went to see my native team outside of Fenway Park, and was shocked by the greeting I got at the gate.

The importance of water can’t really be overstated, despite its low sexiness quotient. While we can get by without such voluptuous libations as beer, wine, soda, and single-malt whiskey — however miserably — we can’t survive for long without boring old water. But… lucky us, water literally flows from our taps, so we need not worry. Not, at least, if we are named Pollyanna. The rest of us might feel a slight chill at the news brought in the updated edition of Colin Ingram’s The Drinking Water Book: How to Eliminate Harmful Toxins from Your Water (Celestial Arts, $14.95).
The chilling news isn’t really that municipal tap water from coast to coast is something less than pure. What is disturbing is Ingram’s contention that such routine additives as chlorine (a disinfectant used in virtually every municipal water system in the country) and fluoride (a widely deployed weapon against caries) might well cause more problems than they solve. Chlorine combines with organic chemicals already present in water from industrial pollution to form trihalomethanes, which are known carcinogens and, in Ingram’s words — and a testament to both the ubiquitous use of chlorine and the pervasiveness of industrial pollution — are “present to some degree in all public water supplies.”
Fluoride, meantime, once thought to be a kind of miracle preventive for dental cavities in children, turns out to be a substance whose benefits and detriments to human health are hotly contested. While rates of tooth decay have declined in populations drinking fluoridated tap water, Ingram notes, they have also declined in populations drinking nonfluoridated tap water; and it is suggested in some quarters that fluoride is of a toxicity to humans comparable to that of lead and arsenic.
Ingram lays out these pro and con arguments evenhandedly, but in the end he advises prudence: Don’t drink fluoridated water on a regular basis. And don’t drink chlorinated water on a regular basis. In other words, don’t make a habit of tap water.
What then to do when thirst strikes? The book discusses filtration systems in some detail; even such simple apparatuses as filter pitchers are judged to be worthy. If you must make do with tap water, don’t drink the first few seconds of flow, and let the water stand in a pitcher for a few minutes (with a stir or two) so that volatile chemicals can dissipate. The first thing I did when I learned that private housing developers in San Francisco were demanding 28 percent profit levels (see page 5) was to call my brother Mike, who runs a small business building houses in New York. He almost dropped the phone.
“Let me get this straight,” he said. “These guys say they need 28 percent profit?” That’s the minimum, I told him.
“Shit, sign me up,” he laughed. “I’ll take the whole crew and we’ll be on the next plane.”
Mike is thrilled when he walks away with 10 percent profit on a job. So is everyone he knows. So are most small businesses (and quite a few large ones). The only ones who can get away with demanding that sort of return are oil companies, daily newspaper publishers, and, it appears, San Francisco real estate developers.
This isn’t really shocking news: We’ve known for a long time that developers make a killing in an inflated housing market. Compared to the boom years of the 1980s, when the office market was running rampant and out of control, the 28 percent margins aren’t that outrageous – high-rise office developers made even more.
But there’s a bottom line for the city: These folks aren’t just getting rich; they’re getting really rich – purely off a market that exists simply because of the appeal of San Francisco. They owe it to the city to give more than a pittance of that back.
Now this: Just about every small-business owner in San Francisco is sitting down with a spreadsheet and trying to figure out how much Sup. Tom Ammiano’s health care legislation is going to cost. A lot of them seem to be nervous – in part because of the fearmongering campaign put out by the Chamber of Commerce and the Committee on Jobs.
But when you actually look at what the law says, it’s not that scary. I’ve gone over the final language, and here are some key points:
1. The requirement that employers pay for health care doesn’t affect anyone with fewer than 20 employees, which is most of the small businesses in town.
2. Nobody’s going to have to pay anything until July 2007, and companies with between 20 and 50 employees aren’t going to have to pay anything until April 2008.
3. There’s a 90-day waiting period before anyone has to pay for a new employee.
4. Nobody will have to pay for employees who either have health insurance already (from a spouse, say) or who voluntarily decline health insurance.
5. Employers will pay based on how many hours an employee works, so the price for a part-timer will be comparatively small.
6. If you have more than 20 employees and don’t currently provide health insurance for all of them (or the amount you pay for that insurance is low), you’ll have to ante up, either by buying insurance in the private market or paying into the city plan. For companies with 20 to 99 employees, the city plan will run about $1.12 an hour next year for anyone who works more than 12 hours a week. Pencil it out; it may not kill you.
It’s absolutely an imperfect system. Employer-based health insurance is the wrong model. But for now it’s all we have – and this is a way to offer at least basic primary health care to everyone in the city. It’s worth the price. SFBG

A San Francisco–based political pollster is showing there’s little it won’t do to keep an AFL-CIO affiliate from organizing its phone-bank operators.
The respected Field Research Corporation provides survey data for major newspapers across California, including the San Francisco Chronicle. The company is perhaps best known for its Field Poll, which gauges public opinion on everything from electoral candidates and earthquakes to steroids and immigration. The company also performs taxpayer-subsidized surveys for some local government agencies.
In June the Guardian reported that 80 percent of the company’s 50 or so phone surveyors had signed a petition to join the Communication Workers of America Local 9415, hoping they could negotiate wage increases (they get San Francisco’s minimum right now, $8.62 an hour, with 50 cents extra if they’re bilingual), greater health care opportunities, and general workplace improvements. Some workers told us in June that current conditions promote a high turnover rate.
The company refused to recognize their petition, however, so now the National Labor Relations Board will oversee an election scheduled for July 20. Since our last story [“Questioning Their Bosses,” 6/7/2006], Field Research has instituted an aggressive campaign to discourage workers from joining the CWA by distributing inflammatory memos that suggest the union would work against their interests and not do much more than collect dues.
“Unfortunately, [the tactics are] par for the course for corporations these days,” said Yonah Camacho Diamond, an organizer for Local 9415. “However, the one surprising thing with Field Research is they have public projects. They’re seen as having a lot of integrity, but these are Wal-Mart tactics. We’ve got solid supporters, but this stuff is taking its toll on the workers. It’s coming at them daily.”
A memo to employees sent out by chief financial officer Nancy Rogers invites them to attend a paid “session” in which they’ll be given “factual answers to your questions” about union representation. The sessions for the most part appear to demonize the CWA and warn in grave terms what could happen to the workers’ pay if they go on strike. One handout suggests their hourly wage could drop more than three dollars to the federal minimum of $5.15, based on a strange interpretation of the city’s minimum-wage ordinance. Another handout features a table that purports to show how little any wage increase resulting from a strike would benefit them.
“This chart shows the length of time needed for you to make up losses (assuming you were not permanently replaced) during a strike if the union calls for one and then later gets you a 50 cent per hour increase,” the page reads. “We hope this would not happen here, and we would bargain in good faith, but you never know.”
Using Local 9415’s own annual financial reports, the handout goes on to imply that the CWA spends union dues enriching its own staff administrators. The union told us that, in fact, some 80 percent of 9415’s income goes to representing its members. The local’s president earned $57,000 last year.
Another memo sent to employees by Rogers in May threatens, “Many of you think that by getting a union, your wages, hours, and working conditions will automatically change. This is simply not the case.” She writes that the company would not enter into agreements that could “eliminate the jobs of many of our part-time employees,” despite concerns expressed by at least one employee about the quality of survey data produced by temp workers. The employee, Daniel Butler, claimed to us in June that he was suspended for three days as a result of his complaints.
On July 11, Sup. Chris Daly proposed a resolution condemning Field Research’s “unethical actions to intimidate employees” and the company’s “antiunion ‘captive audience’ meetings.”
“Field Research Corporation has revenues in the millions of dollars, only pays pennies above the minimum wage required by San Francisco law, and doesn’t offer health care to the overwhelming majority of their employees,” the resolution reads. The full board was scheduled to consider the resolution July 18, after our deadline.
CFO Rogers and Field Research site manager George Nolan did not return calls seeking comment.
One phone-bank operator, Oriana Saportas, who commutes from the East Bay for 22 hours of work each week, admitted she believed some of the workers who originally signed the petition had been persuaded to vote against Local 9415 by Field Research’s antiunion campaign. She said that during the information sessions the employees were divided into four groups, including one group containing those who seemed to be most in support of the union. She says now she’s not entirely sure which way the election will go.
“I asked [Field Research] how we could have a voice without a union…. They didn’t really give me a straight answer,” Saportas said. “Not every institution is perfect. Not even the union. I know that. But we need a voice.” SFBG

Sup. Tom Ammiano and Mayor Gavin Newsom took another step today towards making health care accessible to all uninsured San Franciscans.
The San Francisco Health Care Security Ordinance, which Ammiano and Newsom announced their joint support for July 11, offers access to comprehensive medical services, while requiring that medium and large business meet minimum spending requirement on employees’ health care.
While the agreement is optimsitic, it wasn’t reached without compromise on the employer spending mandate.
From July ’07, when the ordinance would become law, until Jan. 2008, employers will have to provide healthcare for employees who work 12 hours or more. That requirement tightens to 10 and then 8 hours, in Jan. ’08 and Jan.’09, respectively.
Meanwhile, medium sized businesses, (20-50 employees) have until March 31 2007, to start making mandatory payments, (which amounts to about a $1 an hour per worker.
Other tweaks: employers won’t have to make health insurance payments, if their employee has coverage elsewhere (through a parent, a spouse, or presumably another job), but the employee decides who pays.
Of all three compromises, the 12-10-8 compromise spells the greatest danger for the local labor pol (what if stores cut workers’ hours to 11 each per week?)
A special Budget and Finance Committee meeting is set for Monday July 17 at 1pm, and the full Board will discuss it July 18, with a final vote expected on July 25.

Playing hardball in the Presidio

EDITORIAL When Rep. Nancy Pelosi began peddling her plan to privatize the Presidio back in the 1990s her chief weapon was fear: If the Democrats didn’t cut a deal to let the private sector control the fate of the new national park, she argued, the Republicans who ran Congress would simply sell off the land. Then there would be no park at all.
That was a highly unlikely scenario — there was a Democrat named Bill Clinton in the White House, and it’s hard to imagine him going along with the GOP on the sale of 1,491 acres of parkland in San Francisco (part of his loyal California base). But even if that happened, we argued at the time, San Francisco wouldn’t have been helpless: The city at least could have had some zoning control over the private land.
Instead, we’ve wound up with the worst of all worlds — a park controlled by an unelected, unaccountable federal trust that’s dominated by real estate and development interests, that has already handed over big chunks of the park to the private sector (George Lucas and others), and that refuses to abide by any local land-use regulations or ordinances.
That’s the problem at the heart of the dispute over the plan to build 230 luxury condominiums and apartments on the site of the old Public Health Service Hospital Complex just off Lake Street. Neighbors want a smaller project, one more in sync with the (relatively) low density district. More important, Sup. Jake McGoldrick, who represents the area, wants to see the developer add some affordable housing to the mix.
But the Presidio Trust has no interest in affordable housing. For the Bush appointees who run the park, the only thing that matters is the bottom line. Luxury units mean more profit for the developer and more cash for the trust. The needs of San Francisco aren’t even part of the equation.
This is what Pelosi wrought, with the help of then-mayor Willie Brown and the entire old Burton Machine (along with the Sierra Club and other environmental groups), and it is the most enduring legacy she will leave behind. (See “Plundering the Presidio,” 10/8/1997.) It’s important for every activist infuriated with the arrogant behavior of the Presidio Trust to remember that — and to start mounting some real pressure on Pelosi to undo the damage and repeal the Presidio Trust Legislation. The Presidio is a national park and ought to be run by the National Park Service.
In the meantime, though, the city has no choice but to play hardball. McGoldrick was only half joking (if he was joking at all) when he suggested that the city close portions of 14th and 15th avenues — literally blocking off the only entrance to the Presidio from the Richmond, a move that would seriously damage the new development. The city can also deny water and sewer service, which would pretty much end any plans for luxury housing.
Those aren’t pretty solutions — but if the trust won’t back down and at least meet the city’s requirement for affordable housing, McGoldrick and his colleagues should pursue them. SFBG
