GREEN CITY At long last, the San Francisco Public Utilities Commission appears to be moving forward with plans to address long overdue environmental justice issues (“It Flows Downhill,” 08/08/06) that are directly related to its sewage treatment plant in the city’s southeast sector.

At a May 27 SFPUC meeting, SFPUC staff recommended that the agency build a new digester facility in the southeast part of town and divert 12 percent of its sewage flow to the west side’s Oceanside plant, (which, incidentally, a current signature-gathering campaign hopes voters in November will rename the George W. Bush Sewage Treatment Plant).

For decades residents of Bayview–Hunters Point have endured foul smells, thanks to the close proximity to their homes of the Southeast treatment plant. The site treats 76 percent of the city’s sewage in facilities that are almost entirely outdoors. By contrast, facilities at the Oceanside plant, in a wealthier side of town, are mostly indoors and/or underground.

It’s an unequal division that has long had southeast residents claiming environmental racism. To make matters worse, the Southeast plant contains nine pancake-shaped digesters that could experience problems in an earthquake, with worrisome corrosion on the undersides of the digesters’ covers.

Cost estimates for a new digester facility range from $700 million to $1.3 billion. This variation depends on the location choice for the new digesters: if the agency builds new digesters on the south side of its existing Southeast plant, the agency is looking at the cheaper end of the scale.

But if the SFPUC follows another option to build a new facility on the back lot of Pier 94, a Port of San Francisco property, it would remove the plant from a residential neighborhood but be left facing a near doubling of the cost.

Replacing the digesters was a pet cause of former SFPUC General Manager Susan Leal, and continues to be a priority for District 10 supervisor Sophie Maxwell, so it’s likely to remain a key focus for former City Controller Ed Harrington, who took over as general manager of the agency after Mayor Gavin Newsom ousted Leal.

"You’ll see immediate work on the digesters," Harrington assured the commissioners. "The PUC is suggesting doing on an environmental impact report on both sites."

That report likely won’t be complete until 2010, when the agency leaders will have to choose an option. PUC project manager Jon Loiacono seems to be keenly aware of the thorny issues at play and told the commission that "staff would like to work with an advisory group and hire a consultant sensitive to community issues to find the best solution."

"It would almost certainly be less expensive to rebuild on the current site, but we don’t want anyone to make the digester decision based on cost," PUC spokesperson Tony Winniker told the Guardian.

"We really want it to be a public health and safety decision," PUC Citizens Advisory Committee chair Alex Lantsberg told the Guardian.

The digester replacement cost represents a significant chunk of the total estimated price tag of the PUC’s proposed sewer system master plan, which ranges from $3.8 billion to $4.4 billion. PUC staff is also outlining plans to send some of the waste westward in what the PUC currently calls "the Upper Alemany diversion."

The plan involves building a tunnel near Cayuga Creek, where runoff water tends to back up, and carrying it to the Oceanside plant. So, is this the return of the dreaded cross-town tunnel, an idea that had irate Bernal Heights residents waving plungers at City Hall three decades ago? PUC staff claim it is not.

"It’s a different concept, but similar," Loiacono said of the current plan.

"This reduces how much waste is treated in the Bayview and shifts it to a plant where there is excess capacity," Winniker explained, further noting that while the old cross-town tunnel would have run under Bernal Heights, this diversion will use city rights of way.

The project would improve drainage for the Cayuga and divert about 10 million gallons of sewage per day from the Southeast plant to the Oceanside plant, PUC spokesperson Tyron Jue told us. The alignment hasn’t been chosen yet, but Jue said, "we’re considering different routes, like Brotherhood Way or Ocean Avenue."

Whatever path the SFPUC pursues, the project won’t be cheap — economically or politically.

Since the crash of Tallula a few years ago, the Department of Innovative Indian Food has undergone some slight shrinkage. True, the overall standard of Indian cooking in the city has continued to rise, and we’ve been treated to spots that emphasize regional Indian cuisine, such as Dosa. But where oh where is the restaurant that will cook a well-spiced duck in the tandoor, then serve the meat in slices as part of a salad with arugula and bing cherries? Tallula was brilliant at this sort of cross-cultural flourish, and I was hopeful it would be the first of its profuse kind.

Perhaps, despite its too-short life, it was. The second of its kind could be Roti, in West Portal — a much better-looking restaurant than Tallula, though shyer about proclaiming its more distinctive dishes. (There is a sibling restaurant in Burlingame.) You could feast quite happily at Roti on the subcontinental foods that have become familiar and perhaps even beloved in certain quarters of blue-state America: tandoori chicken, lamb vindaloo, palak paneer, chana masala. But you might suspect you were missing something, your first clue being Roti’s appearance.

The phrase the restaurant applies to itself is "Indian bistro," and this means, first, no stainless-steel steam tables pushed against the back wall for all-you-can-eat buffets. It also means a Manhattanish look of glossy surfaces and striking lamps and light fixtures arrayed behind a barrel façade of window panes that arc inward toward the door. The effect is a little like that of the original Slanted Door, though with a curve instead of a slant. Certainly the intent of the two places seems similar: to do justice to an ancient cuisine while reconciling it with the reality of modern California.

Hence Roti’s splendid tandoori duck salad ($12), with meat dense, moist, and tender, almost like confit. Tallula’s menu was filled with these sorts of combinations; at Roti, there is a stronger sense of restraint regarding the ecstasies of Californication, along with heightened attention to some traditional Indian dishes that are less well-known in this country. If you think Indian cooks only use lentils to make dal, for instance, you’ll be pleasantly surprised by dal ki mathri ($8), a set of fritters made of several varieties of legumes, including chickpeas. The fritters could have been warmer (they seemed to toughen with cooling) but were complex in flavor and texture. Also, they were endearing in appearance — little golden footballs that could have been part of a Pop Warner awards presentation.

Calamari rings ($8) were given the "Bombay" treatment: a heavy dusting of curry-scented chickpea flour, then a turn in the deep-fryer for some golden crunch. The rings were presented with little dishes of chutney, tamarind and mint, but they were tasty enough to be eaten straight up. They were also tender, which suggested skillful handling, since calamari easily turns rubbery with overcooking. One of the blights of Indian restaurants is that so many of the appetizers and starters are deep-fried, and Roti’s are no exception. But if you must go deep-fried, calamari is at least somewhat less usual than pakoras or samosas.

Chicken tikka — boneless breast meat — turns up in a number of preparations. Among these are the lovable old warhorse, chicken tikka masala ($14), cubes of meat awash in a mild, creamy sauce; and a lunchtime salad ($12) in which the breast meat is rolled up, roulade-style, roasted, and served over mixed greens with naan. Considering the dryness of roasting and the paucity of fat on boneless, skinless, chicken breast meat, the chicken tikka here was remarkably juicy — a credit, maybe, to some ingenious marinade.

Lamb vindaloo ($15) arrived with the chicken tikka masala and in some ways resembled it: cubes of meat in a rich-looking sauce. But vindaloo is generally hotter and sharper than its sibling, and here it was markedly gingery, too. (Vindaloo comes from Goa, once a Portuguese colony, and, as the name implies, wine was a long-ago ingredient. In these postcolonial days, some kind of mild vinegar is generally used.)

As so often is the case in Indian restaurants, vegetarian offerings are strong and varied enough to banish any vagrant yearnings for meat. The only one of these dishes we found wanting was, surprisingly, the palak paneer ($11), lightly spiced spinach cooked with chunks of cheese. The spicing here consisted mostly of nutmeg, which really didn’t have the wattage to compete with chana masala ($9), chickpeas cooked in a spicy tomato-curry sauce. Somewhere between these two extremes lay the mattar kurchan ($10 at lunch, with a disk of poori), cubes of cheese cooked with green peas in a moderately athletic tomato sauce. The sauced cheese would have been excellent spooned over the poori to make a kind of pizza, but I didn’t think of that in time. And it would have been tricky to eat.

How about dessert after all that? We stuck to the ice creams and were well satisfied: two scoops of peach-colored lucuma ($5) and a plate of kulfi ($6), flavored with saffron, cardamom, pistachio, and rosewater, shaped into a sausage, frozen, and sliced like a banana.

As we were getting up to leave, the disputatious person seated to my right said, "It’s good, but not as good as Metro Kathmandu." I felt obliged — politely! — to dispute this diss. Roti is quite as good in its way as Metro Kathmandu, and that’s saying something. (It’s also indisputably better-looking, and that’s saying something else.) The death of Tallula was a real loss but, as Roti proves, not an unredeemed one.

Black Angels alight in SF

If you’re going to name yourself after one of the Velvet Underground’s most epic noisefests, you’d best be well prepared to bring the drone and stir the squall – we want sheets of feedback and hopefully plenty of nervous dread to go along with it. Such requirements are not an issue for Austin, Texas’ Black Angels.

Named for the Velvets’ signature drone piece “The Black Angel’s Death Song,” these folks remain one of the most convincing modern-day practitioners of late ’60s/early ’70s, antisocial psychedelia. Tapping into the bad acid comedowns and anti-Summer of Love vibes of the Velvets and the 13th Floor Elevators – with occasional devil dances in the direction of vintage Rolling Stones as well – the Black Angels specialize in delicious creep-outs and electrifying forays into the psyche’s darker recesses. Most importantly: they know how to write riveting songs, rather than merely settling upon a mood and a groove and sticking with it. See for yourself this Saturday, June 7, when they play the Independent. In the meantime, may I suggest practicing your strut. Oh, and maybe work on your most menacing lurch as well.

The Black Angels have just released their sophomore full-length, Directions to See a Ghost, and to these ears it feels even more focused than their blindsiding 2006 debut, Passover (both Light in the Attic). I must ‘fess up: I’m completely and utterly in love with the packaging as well. Boasting a day-glo pink and neon green concentric-circle op-art design – and what’s more, it’s embossed – there’s something immensely satisfying in losing oneself in the spirals as the Black Angels rattle out a steady prowling rumble. Plus, it’s embossed! Who doesn’t like feeling art and having it feel you back? It’s a damn shame you can’t run your fingers over the computer screen right now and see – no, feel – exactly what I mean:

Death metal’s best? Arch Enemy to dominate Slim’s

These may be the enlightened days of reinvigorated heavy metal madness, but San Francisco hasn’t hosted a lineup of melodic death metal bands this hefty in a long time. On Thursday, May 29, at Slim’s, Sweden’s ever-fierce Arch Enemy leads the charge of sweeping arpeggios and throaty declarations on the second-to-last stop on their brief North American “Tyranny and Bloodshed” tour. Joining the brutal quintet are three Century Media label mates – compatriots Dark Tranquility, Divine Heresy, and Greece’s death metal offering Firewind. Insert a proper horned salute to Slim’s here for carrying the torch of loud, heavy music of late (Death Angel, Exodus, Slough Feg, and on Friday, May 30, Candlemass and Soilent Green).

Though hardly a household name, Arch Enemy has caught on with metal listeners. Their seventh full-length studio recording, Rise of the Tyrant (Century Media, 2007), debuted last September at no. 84 on the Billboard charts. It could have been higher had the genre’s fans not spent their audio allowance on another new release: Dethklok’s epic cartoon metal album, The Dethalbum, which clocked in at 34,000 copies during its first week out, making it purportedly the best-selling death-metal album to date.

Assembled in 1996 by former Carcass guitarist Michael Amott and ex-Carnage bandmate John Liiva, Arch Enemy’s infant days were especially notable for the technically devastating dual guitar work of brothers Michael and Christopher Amott. In 2001, the group replaced Liiva with a new vocalist, Angela Gossow. Arch Enemy’s since become lazily tagged as that band with the hot blonde Valkyrie who can growl as gutturally as any angry and seasoned death metal dude. Regardless Gossow holds her own in very male-dominated, aggression-fueled scene. (Fellow journalists with metal ambitions take note, there is hope: writing for a German metal mag at the time, Gossow landed the Arch Enemy gig after giving a demo tape to Christopher Amott during an interview.)

"The angels in the summertime are ashes in the fall. As Eden fell so heaven shall. I will burn them all."

The sign, written in gothic letters on weatherworn plywood with faded red flames, is nailed to the side gate of a two-story duplex off Martin Luther King Jr. Way in north Oakland. Today, the old sign’s words carry a chilling new meaning, greeting visitors to a house whose insides were scorched by an unidentified arsonist.

The charred house has been a cauldron of contention for more than 10 years. It has been the product of two anticapitalist housing experiments, one started by an environmentalist landlord who sought to create an ecotopia, and the other by a group of anarchists who intended to make it their home. In the process, it became a hub for traveling activists and aspiring hobos, and a headquarters for antiestablishment endeavors such as Berkeley Liberation Radio.

"People would hear about it through the grapevine, hop off a freight train, and show up on our doorstep with a backpack, a banjo, and a Woody Guthrie song," says Steve DiCaprio, a tenant who moved into the house in 2001 with his wife after living in a van out front. "We had an open-door policy. Anyone could come in, no questions asked. They just had to abide by certain rules: no hard drugs, no racism, no homophobia, and no violence. We wanted to emphasize equality — it was a reaction to the closed, materialistic, competitive, dog-eat-dog society we live in."

The house originally was part of the green property owner’s attempt to create a network of sustainable, affordable housing. When his project floundered, the residence was slowly taken over by his tenants, a group of people who one-upped his radicalism. Both sides claimed to be avowed anticapitalists, but their strategies were at odds; his was to produce an alternative to the local housing market by creating a nonprofit that would help tenants own their homes as a collective. Theirs was to make space for themselves in a rent-based housing market by seizing property from investors and absentee landlords.

The owner eventually went bankrupt — drowned in the early stages of the current defutf8g housing market — and the property fell into the hands of a small-time real estate investor, despite the tenants’ attempts to buy it themselves. The tenants refused to leave, transforming themselves into squatters, and fought it out with the buyer in court for three years. As the court case bogged down, housing values plummeted, making the landlord’s investment lose value by the day.

On Feb. 28, when one of many hearings was set to take place, the squatters showed up in court but the landlord hadn’t filed the paperwork needed to move the conflict closer to a resolution. The following night, in the early hours of March 1, someone lit three fires in the empty upper apartment, setting the house ablaze as people slept inside.

WELCOME TO HELLARITY


For years the house has been known as "Hellarity," although its original owner never called it that. In fact, he refuses to. To recognize that name would be to legitimize the people who adorned it with the title — a group he sees as thieves, squatters who disrupted a legitimate project he thought would have a small but tangible impact on a profit-driven housing market.

Born on the Sunrise Free School in northeastern Washington State, Sennet Williams — known by most as "Sand" — spent his early years bouncing between Spokane and "environmental and pacifist intentional communities" in the area. A year after moving to Berkeley in 1990, he graduated from UC Berkeley’s Hass School of Business. With a degree in urban land economics, he wanted to do his part to turn the tide of environmental degradation by developing "nonprofit car-free housing" in Berkeley.

Williams didn’t see attending business school or investing in property as contradictions of his ideals. For Williams, they were strategic moves. He thought that anticapitalist projects lacked an important element — money — and wanted to be a benefactor for alternative forms of housing.

One week after graduating, his dreamy aspirations came to a crashing halt when an SUV plowed into his compact car while he was on a ski trip at Lake Tahoe, badly injuring him and causing brain damage. His goals would have been quickly destroyed, but Williams sued the driver and convinced the court that the accident interfered with his budding career, winning a settlement in 1993 that he says was "almost a million dollars."

While his money was tucked away in mutual funds and he was living briefly at a student co-op in Ann Arbor, Mich., in 1994, Williams solidified his ideas into an ambitious project called the "Green Plan" with some of his housemates. The plan was an elaborate scheme to "end homelessness" by creating "an urban nonprofit dedicated to self-governing and radical environmentalism" that would fund "rural sustainable ecovillages in Hawaii and elsewhere."

That summer, Williams bought five houses on credit in what he calls Berkeley’s "’80s drug-war zones" and brought his Ann Arbor friends to California to turn his rundown properties into co-op material. Over the summer, the Green Plan became an official organization and Williams let its members live in his houses without paying rent. Instead, they were expected to pay monthly dues to their organization — roughly the equivalent of fair market rent — to put toward buying rural land or repurchasing the houses from Williams at cost. Those who couldn’t afford to contribute were allowed to stay free in exchange for working on the houses, doing extra work for the Green Plan, or volunteering in its Little Planet café.

"Sennet (Williams) tried to be clear that he wasn’t a landlord," says former Green Plan member Dianna Tibbs, but relations between Williams and the members quickly disintegrated. Three years after its formation, the Green Plan remained unincorporated as a nonprofit. A former member also said it was still too centered on Williams’ ideas. Williams’ relationship with the tenants soured. "Ultimately there was a rebellion among the people against Sennet," Tibbs says. In 1997 the project disbanded, transferring all of the money they had raised — about $50,000 — to the Little Planet café.

The Green Plan fell apart, but Williams was caught up in the fervor of the mid-90s real estate market. In 1997, he bought the house that would later be named Hellarity for $114,000, with the goal of "making it into a demonstration of an eco-house that would be an educational resource for the city." He says he chose that property in part so it "could be a tribute to the Black Panthers’ goals of providing food in the inner-city," as it was on the same block as the home of Black Panthers founder Bobby Seale.

But shortly after Williams bought Hellarity, he says he became "overextended in real estate." By the time he made his first mortgage payments, he says there were "over 60 people" living in his houses. He owned eight in Berkeley, two in Oakland, and was planning to buy farmland in Hawaii. With Williams tied up in too many projects to fix up Hellarity, he moved in some people to "house sit" in exchange for free rent.

Shortly after people moved in, Williams stopped coming around the house. The housesitters gradually brought in their friends, the walls were slowly painted to suit the eccentric tastes of the occupants, and more people started calling the house theirs. Williams said he didn’t invite them, but admits that he never asked them to leave. He had little contact with the occupants as years passed. "He was just a theoretical person that owned the house," DiCaprio says.

Hellarity took on a distinctly anarchist flavor in Williams’ absence. "People with alternative lifestyles and alternative family arrangements could live without having to dedicate their lives to making money, giving them more time to invest in their homes and their communities," says long-term resident Robert "Eggplant" Burnett, Bay Area punk rock legend, publisher of the zine Absolutely Zippo, and editor of Slingshot newspaper. Hellarity hosted the pirate radio station Berkeley Liberation Radio, a do-it-yourself bike shop, and cooked meals for Food Not Bombs.

It seemed like an anarchist paradise, but it wouldn’t last.

FOR SALE


By 2004, mortgage payments were driving Williams deep into debt, and Hellarity became a burden. The house was being pulled away from him from two sides: by anarchists who increasingly challenged the legitimacy of his ownership, and by creditors who placed liens against his properties.

When Hellarity was eventually sold by the court in a bankruptcy sale, the tenants say the man who would buy the house, Pradeep Pal, had never set foot in it. Pal, who refused to be interviewed for this article, lived in an upper-middle class neighborhood in Hercules and owned two businesses, Charlie’s Garage in Berkeley and European Motor Works in Albany. He wasn’t exactly a freewheeling real estate flipper — he was a South Asian immigrant who, according to Guardian research of property records, never owned real estate in the area other than his own home.

But to the tenants, Pal was a capitalist trying to buy them out of their home. In a recorded meeting with tenants, Pal admitted he hadn’t been inside the house before he bought it, and Williams tells us the real estate agent who arranged the sale also never toured the house before Pal bought it. "He obviously had no interest in moving into the place or contributing to the community if he didn’t even look at it," future occupant Jake Sternberg says. "This was someone who just wanted to make a profit."

The tenants made it clear to Pal that they didn’t want him to buy the house and would make life difficult for him. As soon as it became apparent that Williams would lose the house, Crystal Haviland and a few other occupants started searching for someone to help them buy the house. In the summer of 2004, the house was slated to go up on foreclosure auction, but the tenants hadn’t found a sympathetic donor.

The auction was set to occur on the steps of the René C. Davidson Alameda County Courthouse, and the occupants showed up banging drums and bellowing chants to warn off prospective buyers. "We wanted anyone interested in buying the house to know that the people who had been living at the house for 10 years wanted to buy it," says Haviland, who is now raising a child, studying psychology at San Francisco State University, and volunteering as a peer counselor at the Berkeley Free Clinic. "We didn’t want people to buy it and turn it into an expensive gentrified thing." While people gathered, Williams showed up and announced bankruptcy, a legal move that cancelled the auction.

With more time to search for financial support, Haviland started talking with Cooperative Roots, an organization that bought a couple of Williams’ other houses — now known as "Fort Awesome" and "Fort Radical" — in foreclosure auctions. Cooperative Roots is a Berkeley-based nonprofit organized in 2003 by members of the University Students Cooperative Association. They received money from progressive donors — mainly the Parker Street Foundation — to buy houses that they turned into "cooperative, affordable housing," says Cooperative Roots member Zach Norwood. Anyone who lives in their houses is an automatic member of the cooperative and makes monthly mortgage payments to the foundation.

For Hellarity, Cooperative Roots was a godsend. "Other people would walk into that house and say, "This place is disgusting," DiCaprio says. "But they said, ‘Wow, this is a work of art.’<0x2009>" The Parker Street Foundation was willing to put down whatever was needed to buy the house, Norwood says, but the occupants were limited by the monthly payments they could afford. On Nov. 4, 2004, the house went up for bankruptcy sale, and Cooperative Roots was prepared to bid up to $420,000. "It was exciting to be there with a bunch of crazy Hellarity people, putting out bids for hundreds of thousands of dollars," Haviland says.

No one expected them to show up at the sale. Williams says they had previously offered to buy the house from him but he "didn’t think they were serious." By the time they had the money, Williams no longer had control of the sale. At the courthouse, the anarchists were playing by the rules, bidding with money up front. The only other party interested in the house was Pal and his brother-in-law Charanjit Rihal, who were placing bids against the occupants. The two sides bid against each other, driving up the price until the occupants reached their limit. Pal and Rihal took the property for $432,000.

OWNERSHIP VS. CONTROL


"This sale was symptomatic of a housing market gone haywire," says DiCaprio. "People like Pal and Rihal thought they could just throw a bunch of money into real estate and it would always be a good investment. I’m glad the market finally crashed, because that kind of behavior hurts a lot of people. It ended up driving the price of housing to the point that normal people can’t buy anymore — and that’s absurd."

Pal soon discovered he owned the property on paper only. The occupants didn’t recognize the sale or his authority to tell them to leave. Three months after the sale, the occupants were still there, refusing to go. Pal took the case to court in an "action to quiet title," demanding that they be ejected from the property and that the title be freed from any future claims against it. He claimed the people in the house were squatters, living on his property without permission. But before the police could drag out the occupants, they countersued, holding themselves up in court without a lawyer for three years and living in the house the whole time.

One of the first cross-complaints came from Robert Burnett who — with his contempt for the computerized, cell phone-saturated consumer culture — wrote his cross-complaint on the back of a flyer on an ancient typewriter. When the document appeared in court, one side advertised a benefit for a pirate radio station at the anarchist info shop at the Long Haul with an image of tiny people being thrown out of an upside-down Statue of Liberty. On the other side, Burnett claims that he is a co-owner of the house, which he acquired through "adverse possession." Two other defendants made the same claim.

"Adverse possession transfers the ownership of a piece of real estate to people occupying the house without payment," says Oakland attorney Ellis Brown, an expert in property law. "In the state of California, you have to be openly living in a place for five years without the titleholder trying to make you leave to win an adverse possession case."

"Adverse possession originated to prevent Native Americans from taking back land from homesteaders, but squatters turned it around, using it to protect people who take possession of unused property," says Iain Boal, a historian of the commons who teaches in the community studies department at the University of California, Santa Cruz and the author of the forthcoming book, The Long Theft: Episodes in the History of Enclosure. Boal emphasizes the large numbers of squatters in the world, a figure Robert Neuwirth, author of Shadow Cities: A Billion Squatters, a New Urban World (Routledge, 2004), pegs at 1 billion. "It is only here that squatters are seen as bizarre leftovers from the ’60s," Boal says. "We are in a crisis of shelter, and people need to fill their housing needs."

DiCaprio concurs. Along with Burnett, DiCaprio was the main backer of the occupants’ legal case. As we talk in a dark, live-in warehouse, he sips coffee out of a Mason jar and looks over the court case on his laptop. He says he wants to be a lawyer, but he has never been interested in making lots of money — he says he wants to "fight for housing rights." DiCaprio learned squatter law while cycling through family law court, criminal court, and federal court over a Berkeley house he was squatting and trying to win through adverse possession. The city threw him in jail, and he was released just after Pal sued the occupants of Hellarity.

He says Hellarity was different from other situations he’s dealt with as a squatter. "We never thought of ourselves as squatters [at Hellarity] per se until Pal sued us and start using that language in court," he says. "Before he bought the house, no one was challenging our presence on the property. Sennet [Williams] was either actively or passively letting us stay there. By filing a claim to quiet title, Pal made it apparent the title was in question. By calling us squatters instead of tenants, they lost some claim to the property. So we took the ball and ran with it."

Their use of adverse possession was strategic, DiCaprio says, but they didn’t intend to win the house that way. "We were never under any illusion that we would win ownership of the house in court," he says. "We wanted to use the court as a forum to enable us to buy the house. We were just treading water until Pal got tired and agreed to sell." The occupants say they offered him $360,000 for the house, the price it was originally listed for, but he refused to take a loss on his investment.

DiCaprio says the courts generally aren’t sympathetic to squatters’ cases. "Pro pers tend to be poor, so there is a class bias against them," he says, referring to people who represent themselves without a lawyer. DiCaprio says judges have rejected documents for having dirt on them and refused to give fee waivers to people with no income. "The courts do not like squatters. If you mix pro per and adverse possession, you could not have a more hostile environment against us."

For more than two years, Pal and the occupants played a cat-and-mouse game, dragging out the case and trying to complicate it in hopes the other side would just give up. Pal’s lawyer, Richard Harms (who did not return Guardian calls seeking comment), objected to the terms "documents," "property," and "identify" when asked to produce evidence related to his claim. "Instead of trying to prove their case, they were just waiting for us to trip up and not file something before a deadline," says DiCaprio.

The occupants didn’t slip, but as the case wore on, he and Burnett grew tired of upholding their side in court. By fall 2007, the two cut side deals with Pal. Burnett settled for $2,000 and DiCaprio for an undisclosed amount. "I realized I couldn’t save it alone," DiCaprio says. "I told them to sink or swim."

ENDGAME


When Burnett and DiCaprio settled with Pal, the subprime housing crisis was splashing the headlines. Pal’s investment was starting to seem more like a loss, but for the first time since he bought the property, it looked like it would finally be his. By November 2007, the remaining squatters dropped the battle for ownership and began bargaining with him for concessions.

By mid-February, Pal was ready to start renovations, and all but two of the squatters had moved out. They made their final plea and Pal gave his last compromise: two more weeks, then they had to go. "He was sure he was going to get the house, so he agreed to let us stay," says a squatter called Frank, who asked not to be named because of his immigration status.

What Pal may not have understood was that he was not the only party still interested in the house. The house was becoming a point of contention among the larger community of squatters and anarchists in the East Bay. Fissures broke around a central question: was it up to those living there to decide the fate of the notorious squat, or did the larger community of radical activists have a say in the property?

As Pal was getting rid of the last people occupying the house, the squatters’ conflict came to Hellarity’s doorstep. A new group of people came to the North Oakland house, among them a few who had previously stayed at Hellarity, ready to renew the struggle against Pal. Frank, who had been living in the house for seven months, was unhappy about the new arrivals.

"I told them that this kind of action would make problems for me," he says. "I already made an agreement with this guy [Pal] to leave by the end of the month." The new group saw things differently. "We own this place," says Jake Sternberg, the new de facto caretaker of Hellarity, who has since been pushing for the squatters to renew their court case. The discord between the squatters split up the duplex: the two old squatters stayed upstairs while the recent arrivals occupied the lower half.

Two weeks after the new crew moved in, a fire was lit in the upper apartment that burned through the ceiling and the floor. But who did it? Was it a disgruntled squatter who would rather destroy the house than hand it back to Pal? Or was Pal connected to the arson, losing his nerve as a newly energized group of squatters took over and the value of his investment crashed?

If not for the squatters, Pal might have been less affected by the subprime crisis than most property owners. He had no mortgage on the house — he bought it outright — so he wasn’t under threat of foreclosure, unlike tens of thousands of other California homeowners. But Pal faced a different threat. It seems likely he bought the house as an investment, and as the market crashed, he was stuck with a house he could neither renovate nor sell, and was left to watch its value tank as he slogged through court proceedings.

For an investor like Pal, the numbers weren’t looking good. In March, median housing prices had fallen 16.1 percent compared with those of March 2007, according to DataQuick Information Systems, and home sales declined 36.7 percent from the previous year. In April — for the seventh consecutive month — Bay Area home sales were at their lowest level in two decades, DataQuick reported. And according to Business Week, national home prices will plummet an additional 25 percent over the next two to three years.

On Feb. 17, the day after the new group of squatters moved in, Pal made an appearance at the house. In early March, Sternberg showed me a video he recorded during Pal’s visit. On the screen, Pal is sitting on a couch in the downstairs living room of Hellarity. At the door, a well-built man who looks to be in his 30s and calls himself Tony leans against the wall with two younger men who call themselves Salvador and Ryan. Sternberg tells me that Pal came to the house demanding they leave his property. Sternberg called the police, accusing Pal of trespassing. As they waited for the OPD to arrive, which took more than 25 minutes, they discuss their conflict over the house.

At the beginning of the video, Sternberg tells Pal why he and his friends refuse to give up the property: "People came over here from Europe and they said, ‘Hey, we’re going to take this place.’ Now they sell land to each other. And how did they get it? They took it…. And just because somebody pays for something doesn’t mean that they get it. And just because somebody sells something doesn’t mean they have a right to sell that."

A few minutes into Sternberg’s video, Pal told the squatters he was ready to take matters into his own hands. "You just have to deal with me now because what I’m saying is, it’s person to person…. And you know what? If it’s gonna get dirty, it’s gonna get dirty. I don’t care. Because you know what? That’s the way it’s gonna be, because this is what I need. I need to have it. I don’t have any lawyer. I can’t afford a damn lawyer. So it’s gonna be me and you. One to one. Man to man."

Pal eventually left the property after the police arrived, but the two younger men, Salvador and Ryan, spent the night upstairs. "[Pal] had them stay there because they thought the people downstairs would squat the upstairs," Frank says. "He wanted to protect the house." Frank, who says he was concerned that Pal would try to evict him with everyone else, initially didn’t protest the presence of the two young men.

The next day, at Frank’s request, Pal told Salvador and Ryan to leave, and for the two weeks that followed, Pal didn’t return to the house. The new group of squatters expected to see him Feb. 28, the date set for a case hearing called by Pal’s lawyer prior to the re-occupation of the house. If the defendants didn’t show up, a default judgment could have been entered, granting Pal his request to have the squatters removed and ordered to pay $2,000 per month in back rent. The squatters showed up for court, but Pal’s side hadn’t filed the necessary paperwork to hold the hearing.

Once again the house hung in legal limbo and the day after the hearing, the remaining people upstairs moved out as agreed. Frank says Pal called him while he was at work that afternoon to make sure they were gone. For the first time in 11 years, the upper apartment was empty, waiting for either Pal or the other squatters to seize it.

But someone was committed to preventing that from happening. The night after the people upstairs moved out, at around 3:15 a.m., the squatters downstairs awoke to fire creeping through the floorboards above them.

"Both of the doors upstairs were locked," Sternberg says. "We broke through one of the doors and threw buckets of water on the flames."

After the fire department extinguished the blaze, the squatters called the police to have an investigator search the scene. "It appears that unknown suspects entered the house through unknown means, and then set three fires in an attempt to burn the house," the police report states. According to the report, all three fires were set in the upstairs apartment; two burned out before the fire department arrived. Officer Vincent Chen found two used matches in the bathroom, where the wood around the sink had been burned, and a gas can hidden in the bushes on the east side of the house.

When I first met Sternberg, he told me the Oakland Police Department’s arson investigator, Barry Donelan, was helpful. Two and a half months after the fire, however, Sternberg says: "I regret having talked to the police."

Initially, Donelan didn’t know they were squatters — Sternberg had told him they owned the house. "Once he found flyers for a fundraiser to defend the squat, he became angry," says Sternberg. "He said he submitted the case to the district attorney, and didn’t expect anyone would be arrested."

Sternberg says Donelan also threatened to have him arrested for a traffic-related warrant and that he would turn Sternberg’s name over to the Federal Communications Commission, which had an open investigation on the house for hosting Berkeley Liberation Radio. In March, Donelan told us he wouldn’t comment on the case and at press time, he hadn’t return Guardian calls about the status of the investigation.

EPILOGUE


Although the arson may never be solved, the squatters have strong suspicions about who was behind the fire. But they have a hard time deciding who, ultimately, is most culpable for the blaze. "No one involved in Hellarity is innocent, and no one is completely guilty," says DiCaprio. The one point of view everyone seems to share is that Hellarity has long been a tinderbox of contention, in which property owners struggling in a beleaguered housing market faced off against a group of people who reject the market outright for its inaccessibility to low-income people. Eventually, it all literally — burst into flames.

When I visit after the fire, people are sitting outside playing guitar, smoking rolled cigarettes, and singing the timeless hobo ballad, "Big Rock Candy Mountain." The sounds drift over the budding vegetable gardens and into the downstairs living room, where a message written on a big green chalkboard suggests that if the fire was intended to drive people out, it was unsuccessful: "WELCOME BACK TO HELL(ARITY). Because bosses, landlords, and capitalists suck, the house has lots of repairs that need to be done before it becomes fully livable."

Upstairs, Sternberg looks up at a charred, gaping hole in the ceiling. "We have to make lemonade out of lemons," he tells me, explaining that they just got a skylight to fill the cavity. "We’re going to continue fighting just like we’ve been fighting. This guy [Pal] has been in court with us for three years. He’s got no case." *

SPORTS: The westies of Red Sox Nation

A cursory inspection of the sea of fans sporting navy blue and crimson at the Oakland Coliseum this past weekend proved that a) Boston Red Sox fans travel really well. And b) David Ortiz replica jerseys are not limited to “Big Popi” sizes.

Dozens of men, women, teens and toddlers of all dimensions ringed the stadium, spreading New England support from foul pole to foul pole and representing Ortiz, the Red Sox massive slugger. And those not wearing Ortiz’s iconic No. 34 modeled jerseys and t-shits representing the likes of Manny Ramirez, Kevin Youkilis, and Jonathan Papelbon. Sprinkled among them were some retro pieces featuring the numbers of Jim Rice, Carl Yastrzemski and Ted Williams.

No matter how Oakland fared on the field against the visiting Bosox, the Green and Gold bean counters knew in advance they would be big winners at the box office. Boston is the hottest ticket in baseball and the Red Sox currently lead the American League in road attendance with an average of nearly 35,000 fans per road game. Plus, the A’s charge more for their tickets when the world champs come to town. In all the three game set in Oakland series netted 97,592 customers.

But long before the Red Sox won two world championships over the past four seasons, the Red Sox were a big draw in the Bay Area. During the Red Sox inaugural inter-league visit/invasion of San Francisco a few seasons ago, Boston fans famously took over the lower grand stand of the Giants freshly minted ball park.

New England and the Bay Area have their share of bicoastal similarities. Both area have Irish/Italian roots; both have legendary sea ports, each has boho street cred and each region is over-shadowed by neon glitz to the south.

Prior to Saturday evening’s contest at the Coliseum we ventured into the heart of the Red Sox Nation’s west coast capitol and let it’s citizenry speak for themselves.

“I grew up and live in Reno and try to make it out to the Bay Area every time the Red Sox come in. My mom and dad are originally from the Boston area and my half-brother, who is 18 years older than me, turned me on to the team. When I was growing up he brought me a bunch of Red Sox stuff: caps t-shirts, pennants. Naturally, I rooted for them. This is the second time seen the Red Sox this year and the second time we’ve brought our two-year old daughter (out-fitted in Lil’ Popi tee). Red Sox fans are a tight knit group and we run into the same people year after year. This is Red Sox Nation way out west.”

Do people remember Chevron’s abuses? People do

The agenda at Chevron’s annual shareholders meeting will be slightly different this year, as representatives from Nigeria, Ecuador, and Burma descend on the meeting to finally have their say. For years, Chevron has been accused of myriad human rights and environmental abuses, from having nonviolent protestors gunned down in Nigeria to the dumping of toxic waste into Amazon waterways in Ecuador.
Tomorrow, representatives from these countries will voice their concerns directly to shareholders and executives. Amazon Watch Director of Communications Simeon Tegel told us the event was designed to “potentially help shareholders become more active” in pressuring Chevron executives to finally address and rectify Chevron’s abuses.
“One hopes they are human beings too, although sometimes it’s hard to tell. But perhaps they will be motivated to do something, either from pressure from their shareholders or from the kindness of human nature,” said Tegel.
Chevron’s human rights violations are not limited to abuses abroad. Richmond has long felt the sting of Chevron’s environmental negligence, despite the company’s soaring profits. While Chevron promises more energy efficient oil refining methods, they continue to belch toxins into the air over Richmond, and plans for a $1 billion expansion of their Richmond refinery has increased resident’s health and safety concerns.
“Change is a long time coming,” said Rosi Reyes, spokesperson for the Asian Pacific Environmental Network. “Unfortunately, the citizens of Richmond have read through Chevron’s Environmental Impact Report and they feel that there are empty promises. Chevron continues to use equipment that is over 35 years old, and everything in the report points to [Chevron] refining heavier crude oil.”
Reyes said that the City of Richmond’s aims to wean itself of its oil dependent relationship with Chevron: “We want Chevron to put a cap on crude oil and put money into green energy,” she said.
Though contacted repeatedly, Chevron’s Media Relations Department was unavailable for comment.
Although Richmond representatives will not be allowed inside the meeting, they hope to confront Chevron executives through their protest outside. Said Amazon Watch spokesman Mitchell Anderson, “[Chevron] may not be listening, but they will definitely hear us tomorrow.”

Memorial Day in Rock Rapids, Iowa, circa 1940s-50s

When I was growing up in my hometown of Rock Rapids, Iowa,
a farming community of 2,800 in the northwest corner of the state, Memorial Day was the official start of summer.
We headed off to YMCA camp at Camp Foster on West Okiboji Lake and Boy Scout camp at Lake Shetek in southwestern Minnesota. The less fortunate were trundled off to Bible School at the Methodist Church.

As I remember it, Memorial Day always seemed to be a glorious sunny day and full of action for Rock Rapids. The high school band in black and white uniform would march down Main Street under the baton of the local high school band teacher (in my day, Jim White.) A parade would feature floats carrying our town’s veterans of the First and Second World wars, young men I knew who suddenly were wearing their old uniforms. And there was for many years a veteran of the Spanish American War named Jess Callahan prominently displayed in a convertible. Lots of flags would be flying and the Rex Strait American Legion Post and Veterans of Foreign Wars would be out in force. We never really knew who Rex Strait was, except that he was said to be the first Rock Rapids boy to die in World War I and the post was named after him.

After the parade, we would make our way to our picture post card cemetery, atop a knoll just south of town overlooking the lush green of the trees and the fields along the lazy Rock River.
A local dignitary would give a blazing patriotic speech. A color guard of veterans would move the flags into position and then at the command fire their rifles off toward the river. I remember this was the first time I ever saw a color guard in action, with a sergeant who moved his men with rifles into position with strange “hut, hut, hut” commands.

After the ceremony, everyone would go to the graves of their family and friends and people they knew and look at the flowers that would be sitting in bouquets and little pots by the headstones. The cemetery was and is a beautiful spot and many of us who are natives have parents, friends, and relatives buried here. It is one of the wonderful things that connects us to the town, no matter where we end up.

And so this year I got my annual telephone call from the Flower Village florist in Rock Rapids, reminding me two weeks ahead of Memorial Day about the flowers I always place on the graves of my relatives in the Brugmann plot. I always get a kick out of doing business with Flower Village, because it once was in the Brugmann Drugstore building on Main Street that had housed our family store since l902. It later moved across the street to the building that once housed the Bernstein Department store.

I always ask for the most colorful flowers of the moment and the Flower Village people always put them out on the headstones in the Brugmann plot a couple of days ahead of Memorial Day. Then I call Janice Olsen Friedrichsen in Rock Rapids, a second cousin and my date to the junior high school prom, to remind her to pick them up later and use them at her home.

Ours is an unusual plot, because it holds the graves of my four grandparents, my parents, my aunt and uncle and someday my wife and I.

My grandfather C. C.Brugmann and my father C.B.Brugmann spent their entire working lives in Brugmann’s drugstore, which my grandfather started in l902. My father (and my mother Bonnie) came into the store shortly after the depression. My grandfather A. R. Rice (and his wife Allie) was an eloquent Congregational minister who had parishes throughout Iowa in Waverly, Eldora, Parkersburg (just in the news with a terrible tornado), and Rowan. He retired in Clarion. My aunt Mary was my father’s sister and her husband was her Rock Rapids high school classmate, Clarence Schmidt. He was a veterinarian and a reserve army officer who was called up immediately after Pearl Harbor and ordered to report to Camp Dodge in Des Moines within 48 hours. He did and served in Calcutta, India, as an inspector of meat that was flown over the hump to supply the Chinese forces under Generalissimo Chiang Kai-Shek.

Through the years, Elmer “Shinny” Sheneberger, the police chief when I was in school, would say to me, “Well, Bruce, you and I have to get along. We’ll be spending lots of time together someday.” I never knew what he meant until one day, visiting the Brugmann plot, I noticed that the Sheneberger family plot was next to ours. Every Memorial Day, Shinny takes pictures in color of the flowers on the Brugmann and Sheneberger family graves and sends them to me. I send them on to my sister Brenda in Phoenix and the families of the three Schmidt boys John in Cedar Falls, Iowa, and Conrad and Robert in Worthington, Minnesota.

Every year the rep from our American Legion Post puts a small American flag on the grave of every person buried in the cemetery who served in the Armed Forces. Chip Berg, who was three years ahead of me in school, performs this chore every year.

My uncle gets one. And, Chip assures me, I will get one someday. I earned it, I am happy to report, as a cold war veteran in l959-60, an advanced infantryman at Ft. Carson, Colorado, a survivor of two weeks of winter bivouac in the foothills of the Rockies, and a reporter in the Korea Bureau of Stars and Stripes, dateline Yongdongpo. I am proud of the flag already. B3, who never forgets how lucky he is to come from the best little town in the country

P.S. As the years went by, I became more curious about how my uncle Schmitty, as he was known, could leave his three young boys and his veterinary practice in nearby Worthington and get to Fort Dodge so fast and serve throughout the entire war. I asked him lots of questions. How, for example, did he handle his veterinary practice? Simple, he said, “my partner just said let’s split our salaries. You give me half of what you make in the Army and I’ll give you half of what I make in veterinary practice.” And that’s what they did and that’s how the veterinary practice kept going throughout the war. Schmitty returned to a healthy practice, retired in the l960s, and turned it over to his second son Conrad.

P.S. l: Confession: I was not drafted. I enlisted in the federal reserve in the summer of l958, which amounted to the sme thing, two years of active duty, two years of active reserve, and two years of inactive reserve. I did this maneuver so that I could formally say that I beat Elmer Wohlers. Elmer was the local draft board chief who had spent a little time in World War I, “the big one,” as he would say. He had a bit of black humor about his job and we had a running skirmish for years.

Whenever he would see me on the street in Rock Rapids, he would say, ” Bruce, I’m going to get you, I’m going to get you.” And I would reply, “No, no, Elmer, not yet, not yet.” I think he was particularly annoyed when I went off to graduate school at the Columbia University Graduate School of Journalism in New York City. I would send him cards through the years, from a fraternity party at the University of Nebraska, or from a bar in New York City, saying in effect, but with elegant variations, “Elmer, having a wonderful time. Wish you were here.” And so I ended up with an FR for federal reserve starting the number on my dog tags, not a U.S. I still feel good about beating Elmer at his own game.

Andrés Subercaseaux’s sublime dispatches: from ‘Aqui’ to eternity

What a journey. Chilean post-rock/post-electronica composer Andrés Subercaseaux has just released the mind-warping sonic travelogue, Aqui (Triple Down), and I must say, this is one of the more filmic pieces of music I’ve heard in a while.

I realize that the “soundtrack for a nonexistent film” device has blown up into its own genre by this point, but Subercaseaux deserves to be added to the list. By turns funky and uplifting, nervy, and unsettling – and occasionally poignant and quietly evocative – Aqui doesn’t so much create a single “here,” as the title suggests, but rather an entire topography of different “here”‘s. The range here is quite impressive, employing everything from jittery electronica to languid post-rock to freewheeling Tropicalia excursions, and our man handled most of the instrumental responsibilities himself. Anyone who can reference artists as diverse as Tortoise, Stereolab, Os Mutantes, and Brian Eno without resorting to mere pastiche gets big thumbs-up from me.

Aqui starts off with the bubbling, squeaking mood piece “Amazonas,” a soothing instrumental that wouldn’t feel entirely out of place on Brian Eno’s 1975 ambient-pop masterpiece Another Green World (EG/Astralwerks/Virgin). The insertion of what sounds like thumb pianos plucking away in romping loops gives the opener a more playful edge over anything on the Eno album, however. Poke your ears between the track’s bird squawks and the cricket chirps, and the soft glow of single, sustained keyboard notes hovers mid-air.

Marin goes 100% renewable…with natural gas

I’ve been reading through the Marin Clean Energy plan, which is designed to offer customers in 12 potential cities in Marin County the possibility of powering their homes and businesses with 100 percent renewable energy. How can this be, and how can San Francisco do the same?

Their community choice aggregation plan offers folks two options: “light” green (25 percent renewable, ramping up to 50 percent by 2014) or “deep” green (100 percent renewable right out of the gate.) Initially, this will be achieved through power purchase agreements with third-party renewable energy suppliers, while at the same time contracting to build their own renewable power sources and encouraging citizens, through incentives, to put up their own solar panels and wind vanes. (Studies have shown that Marin County has the potential for as much as 846 megawatts of renewables, mostly from solar and wind, though biomass and methane capture are also achievable, especially with all those dairy farms.) The county’s draw is about 240 megawatts.

But my question was if they would still need to rely on natural gas or any other “conventional” power sources as they transition, or to meet peak needs and state-mandated reliability standards.

I queried Tim Rosenfeld, of the Marin Energy Management Team, who has been consulting the county on the plan. “We can’t abandon conventional natural gas generation,” he told me. “It will still be there for firming and shaping our grid, but we will be able to ‘green’ it through our renewable generation.”

Well, while you’re waiting for that “Your DeLorean is ready,” phone call (the waiting list is eight months last time I checked), head over to Al’s Good Food Cafe at Mission and 29th Street. The place is a time machine, itself — definitely where Doc Brown dines when he’s in the Bay Area.

Al’s opened in 1947 and it hasn’t changed much since. From the original Cattle Queen of Montana poster signed by Ronald Reagan to the menu descriptions (“Maiden Christina’s Special: A breakfast feast for the delicate lady with the big appetite…”), the place is steeped in old-school American allure. As “Rockin’ Pneumonia and the Boogie Woogie Flu” played over the speakers, I ate a Jo’s Special — three extra large eggs scrambled with ground chuck, fresh spinach, green onions and mushrooms — and tried to named the movie stars pictured on the walls. Jimmy Dean. Audrey Hepburn. That other guy from Rebel Without a Cause.

But while the décor of Al’s is the real deal (as opposed to, say, Chili’s), the reason to eat there is not the Bing Crosby champagne bottle (“He only gave them to his closest friends,” Jean, my waitress, told me) or the Thank-You note from Florence Henderson. It’s the hospitality. Al’s daughters Jean and Joann have been working there since the restaurant opened, and they keep it grounded in its original principles. “Everyone here aims to please,” Joann told me. Jean added, “My father always said, ‘Soup and coffee is like saying, ‘Hello.’”

Leaving the restaurant, I put on my sunglasses, popped in a lollipop (it came free with the bill), and headed back out to Mission St.—back to the future.

Freelancing comes with a shitload of perks – autonomy, loving your work, self-scheduling, etc. — but it’s not all great. The common myth is that freelancers live in heaven; that they just hang around their spacious lofts all day drinking beer, napping in the afternoon, and writing or painting whenever their bank accounts get low. Well, take it from me; freelancing may be better than office work, but it comes with a lot of bullshit too. For starters, there’s the money issue. Unless you’ve been doing it for over five years, the odds of making rent with your freelance income alone are extremely slim, which means a shitty side-job is a necessity. That basically means you never get a day off. Ever. Another drawback to this line of work is loneliness. Chilling out at home all day may sound nice, but it turns into a soul-crushing nightmare after about a month.

Still, for all the discipline, suffering, and sacrifice freelancing requires, it beats working for the man any day. At least, that’s what I thought before the city started building a goddamn school (or something) right across the street from my apartment. Now, not only am I lonely, distracted, and riddled with anxiety about meeting my deadlines, but I have to pump out journalistic brilliance with a chorus of drilling, welding, cement-mixing, and shouting right outside my window. Which hasn’t been working out so well. The construction site has been so loud lately that I’ve had to move my little operation down to the closest hipster café. Which also sucks because the music is loud, I can’t wear my jammies, and everyone talks constantly.

It’s been bugging me so much lately that I actually started looking into renting a “creative space,” which I knew would probably be impossible, given my financial situation. But, lo and behold, I found a company that offers exactly what I need. GREEN CITY From inside the trailer-size office at Sunrise Farms, one can hear the incessant squawking of 160,000 chickens housed nearby. The Petaluma-based egg producer generates the vast majority of eggs sold in the Bay Area with its seven properties and 1 million hens, one of two large egg operations in a region that used to have thousands of smaller chicken farms.

On one wall of the office a framed aerial black-and-white photograph shows the same property as it appeared more than 70 years ago. The layout of buildings hasn’t changed much over time, still retaining the long, thin structures aligned side-by-side. But in the photograph, little white specks populate the space between buildings — they’re chickens, and all 10,000 were free to wander. Today the birds are kept indoors and, to save space and increase production, are typically confined in small cages. These "battery" cages are stacked in rows four cages high, allowing each bird 67 square inches of room — about the size of a large shoebox.

Although the egg industry says the cage systems are science-based and humane, animal welfare activists say they are cruel and restrict natural behaviors. In November, voters will decide whether to ban the cages in California, thanks to a six-month signature-gathering effort sponsored by the Humane Society of the United States along with other animal welfare groups. As hundreds of veterinarians, businesses, farmers, and politicians — including Assembly member Mark Leno and state senator Carole Migden — continue to endorse the measure, the California egg industry is rallying farmers from across the country against it. If voters approve the law, California’s egg farmers would be required to move the state’s 19 million caged birds into cage-free facilities by 2015.

Since 2002, Florida, Arizona, Oregon, and Colorado have passed similar laws regarding the confinement of pregnant pigs and veal calves in crates — both included in the California measure — but California would be the first state to pass a law regarding the confinement of egg-laying hens. The pork and veal industries have begun voluntarily phasing out confinement practices nationally, and animal welfare groups hope for a similar response from the egg industry if the measure passes in California.

But some consumer groups and egg producers fear the cost of eggs could increase drastically as a result of the new laws. The industry is historically volatile, with prices rising and falling week to week due to disease outbreaks and fluctuating consumer demand. Recently, however, the industry has seen steady growth. The average American now buys around 260 eggs per year, an increase since the 1990s that has resulted in higher profits for the $3 billion-a-year industry.

Although the financial toll the measure would have on farmers and consumers is unclear, the Humane Society touts a study prepared for an industrywide meeting in 2006 as evidence that the cost to switch over to cage-free farming would be minimal. The report claims that the difference between constructing and operating a cage-free facility compared to a caged one amounts to less than one cent per egg. However, the work-up assumes land prices of $10,000 per acre — a fourth of the average land cost in Sonoma County. But even using the higher estimate, the difference is still only slightly more than a penny per egg.

Arnie Riebli, the managing owner of Sunrise Farms, says he disagrees with those figures and doesn’t understand how they were calculated. Indeed, he thinks the cost of cage-free production is closer to double that of caged production. Even so, he says that while initial costs are higher, he receives a higher profit margin on cage-free eggs because of their specialty pricing.

If required to raise only cage-free birds, Riebli says his business will lose its competitive edge to out-of-state producers. One-third of California’s eggs currently come from outside of the state, which means the delivery routes and trucks from the Midwest are established, which means flow could easily be increased. "Every other state is going to sit out there and ship more eggs in here," he says. "They’re not stopping it. They’re just moving it somewhere else."

Riebli’s says he is concerned with his hens’ welfare as much as ever, and has taken trips across the world to research the latest in hen-raising technology. But he stands by his methods. "I use myself as a judge to see what my animals will like," he says. "I go into the building just as I am. If I’m comfortable without a mask, without any protection, then the birds must be too."

The chickens closest to the office are considered cage-free. The 4,000 birds inside the building are fed an all-organic diet and, although quarters are still tight (slightly over a square foot is allotted for each), the birds can dust bathe, perch on posts, and spread their wings. Sunrise Farms reflects the entire industry, since only about 5 percent of its egg-laying hens are raised without cages. In most other buildings, birds are held in battery cages. Ten birds live in each four-foot metal cage.

The eggs are packed on site and distributed through NuCal Foods, the largest egg supplier in the western United States. NuCal also delivers eggs from Gemperle Enterprises, the company whose facility recently came under fire after animal rights activists released undercover footage of severe animal abuse at its farm. Although the farm now claims the video was staged, it showed heinous acts of cruelty, including stomping and throwing hens. More important, it showed the conditions of the hens living in battery cages. Many had excessive feather loss, abnormal growths, and infections.

Riebli says he wants to distance his farm from the cruel treatment shown in the video. Still, he admits that all laying hens are susceptible to cancers, infections, and feather loss, although not usually as severe as what was shown in the video. "There’s a disconnect to where people’s food comes from," Riebli says. "They think it comes from the back of the grocery store, but unfortunately it doesn’t. It has to come from somewhere."

The Riebli family has been in the Petaluma egg business for more than 100 years, and since 1960 his company has grown by joining with other egg producers. The farm survived the Depression, the bird-flu scare, many salmonella outbreaks, and even break-in attempts from animal rights activists. Now that iron bars guard the office windows, Riebli is no longer as worried about criminal attempts against his farm. His main concern these days is that the law, although aimed at protecting chickens, could put him out of business.

"Animals are not human," he says, furrowing his brow and raising his voice slightly. "They don’t have intellect. Chickens probably have brains the size of a pea."

Sara Shields, who holds a doctorate in animal behavior from the University of California, Davis, is among the most vocal American scientists to oppose the use of battery cages. She notes that in Europe, where battery cages were banned in 1999, she’d be considered moderate. She recently released an extensive study comparing the welfare of hens in battery cages to those in cage-free systems. "I would like to see us raise the bar for the treatment of animals," she says. "There’s a limit to how high that bar can be set in cages. I don’t think cages have the potential to be humane."

But most American agricultural scientists disagree and say both systems can be operated humanely, though they grant that poorly-run versions of either type can be disastrous. To prevent mismanagement, United Egg Producers, a lobbying group that represents 85 percent of the country’s egg farms, decided to develop standards for caged production in 1999. They sought out UC Davis poultry scientist Joy Mench to lead a team of scientists in creating these welfare guidelines.

By analyzing the disease, injury, mortality, and productivity rates of birds kept in different systems and spaces, the group developed criteria that the industry subsequently adopted. Among these standards is the 67-square-inch minimum space requirement for each hen. These measures mostly focus on disease and mortality control as well as egg-laying productivity, but have less concern for behavioral welfare.

Although caged birds in modern systems sometimes have lower disease rates than cage-free birds, Shields says the potential for humane treatment in cage-free systems is much higher. Most scientists agree that hens in battery cages cannot engage in many of their natural behaviors, including wing-flapping, nest-building, perching, dust-bathing, scratching, and preening. And although disease control in cage-free systems is more difficult, Shields says, cage-free flocks can be maintained healthfully and successfully.

But Riebli has had problems with one of his younger cage-free flocks at Sunrise Farms. They became startled and piled on top of each other earlier this month, he says, suffocating 20 percent of the birds.

But Shields says this is highly unusual, and points toward newer, aviary-style cage-free systems as a solution for producers who encounter the problem. These methods divide the birds into smaller flocks within the same building, and rely on multiple levels to allow birds to perch and nest. Another potential issue, she says, is the lack of a perfectly-bred hen for cage-free production. After years of breeding hens to produce well in battery cages, breeders only recently have begun breeding for traits that benefit cage-free production. "The bird needs to be suited to the environment, and the environment also needs to be more suited to the birds," she says.

An aviary system costs more to set up than an empty cage-free building, but Shields dismisses these costs. "If we keep racing to the bottom in the name of cheap food, the eventual cost is going to be put on the animals," Shields says. "At some point we have to balance economic costs with moral and ethical considerations."

Over the past two-and-a-half years, a group of 15 politicians, scientists, farmers, and ranchers banded together to do just that. The Pew Commission on Industrial Farm Animal Production released a report last month detailing many troubling issues with the country’s farm animal production. The group specifies that the California ballot measure is a great place to start.

More than 100 cows graze Bill Niman’s 1,000-acre Marin County ranch, but only a couple have ever successfully navigated down the cliffs from the pastures to the beaches. Niman’s home is less than a mile inland, and on clear days he can see across the bay to San Francisco and even Daly City. He founded Niman Ranch on this property in the early 1970s and quickly caused a stir by deciding not to feed antibiotics and hormones to his cows. At first his fellow ranchers didn’t take him seriously, but now nearly all beef producers feed their cattle hormone-free food. More than 30 years later, Niman is determined to use the credibility he has earned to help all farm animals gain better treatment.

Last year, at 63, he gave up his seat on Niman Ranch’s board of directors, effectively ending his involvement with the company he once ran. Now he volunteers with the Pew Commission on Industrial Farm Animal Production. "One of my missions in life is to change the way animals are treated and how food is produced in this country," he says.

As part of the commission’s research, Niman visited one of the nation’s largest caged production houses in Colorado. Despite the state-of-the-art automated system, Niman was not impressed. "It’s pretty hard to put a rosy picture of 1 million chickens living five birds to a cage with no room to move around or stretch their wings," he says. "If I ran the place, I’d have trouble sleeping at night."

Niman believes the public wants to see reform in the food production industry. He says that this measure, and any laws that improve animal welfare, will only expedite what would eventually come naturally due to consumer demand. "I’m not one to advocate more and more legisutf8g, but I also know what’s going on out there," he says. "Change is so critical — and coming — that the sooner that change can begin, and the more orderly and methodical that change can be, the better off everyone will be."

Niman is part of a food movement centered around the Bay Area that includes author and University of California, Berkeley professor Michael Pollan, who also has expressed support for the measure. "The treatment [of hens] is important for reasons for morality, ethics, and sustainability," Pollan tells the Guardian, adding another ulterior motive for changing how hens are kept: "Eggs from hens that live outdoors on grass are a excellent product, even more nutritious and tasty." *

Born too late, on the wrong side of the country, with the wrong rodents hanging from your tail? Considering my abiding love of Elvis Presley, Al Green, Big Star, Shangri-La Records, and Memphis barbecue, I should have perhaps switched lives with Snake Flower 2 vocalist-guitarist Matthew Melton.

The Bay Area transplant from Bluff City still retains the courtly, sweet-tea manners of a Southern gentle-rocker, despite the trouble he’s seen in the name of scorching biker psych, tambourine-bashing vixens named Bunny, and dustups with such garage-rock kin as the Black Lips. When I tell him I have the hots for his native Memphis, Melton’s instantaneous happiness and hometown pride blasts right through the phone line.

"Thank you so much!" he exclaims. "I love Memphis too." He should: Melton’s love of raging garage-rock was honed playing in the city alongside the Memphis Break-Ups and the River City Tanlines, as well as the Lost Sounds’ Jay Reatard and Alicia Trout, whom he performed with in the Bare Wires. No wonder Snake Flower 2’s first full-length, Renegade Daydream (Tic Tac Totally), is so utterly bitchin’: it’s overdriven, romping-in-the-red hot-rod rawk for kids whose minds were forever fractured by dog-eared, rifled copies of Nuggets LPs, Steppenwolf’s gnarlsome guitar tone, Roger Corman cinematic cheapie sleazies, and the Standells’ heightened snot levels. Renegade Daydreams‘ supercharged, fuzz-doused frenzies are the choicest tidbits plucked from, Melton says, "the first batch of songs I wrote after I escaped from the South."

He didn’t intend to end up in Oakland, a town he lovingly describes as comparable to Memphis in its desolation and "blankness." Two years ago, Melton was stranded in San Francisco by his original Snake Flower bandmates, including an ex called Bunny, who, he says, "ended up leaving me for an art school professor who looked like John Lennon. We were touring across country in this Volvo, and by the time we got here, we were at each other’s throats."

After attempting to follow his erstwhile Snake Flowers back to Los Angeles via Greyhound, making it only as far as Santa Cruz, and hitchhiking back to the Bay, Melton decided to simply add "2" to his band name and sally forth, hooking up with and firing various rhythm sections (Paula Frazer filled in as a touring drummer in one early incarnation) until settling on bassist Carlos Bermudez and drummer Johnny Axe.

The supremely "dirty and blown out" sound of the disc, as Melton describes it, comes courtesy of mastering by Weasel Walter and all-analog tracking by Jay Bronzini (the Cuts, the Time Flys) on a Tascam 38. "You get a lo-fi sound that barely meets fidelity standards," says Melton happily. "I’m right there on the cusp. When it sounds too clean, you lose some of the soul and feel of it." In the meantime, Melton is already prepared to make his next long-player, which he’ll record himself on his own Tascam 38 while refining that biker psych tag ("It’s a combination of ’60s garage rock and ’70s motorcycle anthems — like Mad Max meets Alice in Wonderland") that a friend laid on him. He’s even penned a song titled "Biker Psych" for Snake Flower 2’s next seven-inch on German label Red Lounge.

Melton also seems to be finally relaxing into the Bay Area music scene, playing in Photobooth and reforming Bare Wires with the Time Flys’ Erin Emslie. "It took me a long time to assimilate here," he confesses. "Being from the South, I’m very open. Here I feel like I gotta keep my guard up. But I’ve met so many great musicians. I’m not going anywhere." *

Most folks who settle down to watch a Harmony Korine film know not to expect the familiar. Korine is, after all, the guy who wrote Larry Clark’s hot-button Kids (1995), and the writer-director of 1997’s Gummo, one of the head-scratchingest flicks ever to attain cult status. His latest — his first feature since the 1999 Dogme entry Julien Donkey-Boy — is perhaps his most unusual effort to date, but not for the reasons seasoned Korine watchers might expect.

Yeah, Mister Lonely is about a Michael Jackson impersonator (Diego Luna) who falls for a Marilyn Monroe impersonator (Samantha Morton) while performing in Paris. Though she’s married (to a faux-Charlie Chaplin), he agrees when she asks him to come live with her in the Scottish highlands — on a commune populated by even more impersonators, including a Madonna wannabe and a pseudo-Pope. That said, the film is conventionally structured, with three acts shot in a straightforward manner. (Of course, there’s also a parallel tale involving flying nuns — but more on that later.)

"[Mister Lonely] is probably my most traditional story," agreed the 35-year-old Korine, speaking from his home in Nashville. "[My] other films were about deconstructing the narrative or breaking down the story and images — kind of an assault, or a collage, with images and sound coming from all directions. With this, I felt a little bit more peace about the story and these characters. So I decided early on that I should just go with the image itself."

Korine, who coscripted Mister Lonely with his younger brother, Avi, kept his own particular fascinations in mind while writing. "I’ve always been interested in marginalized or obsessive people in real life," he said. "I just thought it was a strange existence — there’s something odd about living as an icon. And visually I thought it was interesting. I spent time on a hippie commune as a kid, and I always wanted to make a movie that was set somewhere slightly communal. I started toying with this idea of impersonators and icons all being together — what it would be like to see Sammy Davis Jr. cleaning his socks, or Abe Lincoln riding a lawnmower. It just felt right."

The commune dwellers, whose farm-bound activities are indeed surreal, though not always played for comedic effect, were carefully cast. Some, like the Sammy Davis Jr. character, were impersonators by trade in real life; others, like French actor Denis Lavant, who plays Chaplin, were not.

"What was most important was that [the celebrities being impersonated] needed to have a certain kind of mythology about them, where the myth could actually bleed into the narrative of the story," Korine explained. "Plus, they were also just people that I liked — I loved all of those characters. And I knew I would never be able to work with the Three Stooges, or Buckwheat, so it was like my attempt at going back."

When it came to plotting out his Michael Jackson, Korine — who didn’t write with Luna in mind but did offer him the role first — had some specific ideas about how the character-within-a-character should look. He’s patterned after Jackson’s Dangerous era — face masks, military armbands, fedoras, and shoulder-grazing straight hair.

"I just thought he looked the best during that period," Korine noted. Earlier, he’d mentioned that while he finds Jackson interesting, he’s not a fan on the level of, say, buying his new albums. "He’s like the world’s greatest eccentric, and that was when he was on his way to becoming this incredible abstraction."

Interspersed between poignant sequences depicting Michael struggling to fit in, even among others of his kind, are a series of increasingly odd occurrences in the Panamanian jungle. A group of nuns — overseen by a bossy priest (Werner Herzog, who also starred in Julien Donkey-Boy) — are shocked to discover they can skydive without parachutes. It’s a bizarre conceit that allows Mister Lonely its most glorious images: nuns joyfully clasping hands in the air while plummeting safely to the ground. Yo, Harmony, what’s that got to do with Jacko?

"I always want to write a novel with pages missing in the right places," Korine said. "I think it’s best to leave some things undefined, to not complete the circle. To me, it was the same movie. They are the same story. The narratives were parallel to each other. They spoke to each other. They both had this idea of faith of and transcendence, wanting to be other than who you are, being outside the system and creating your own language. I knew there would be a certain kind of person who doesn’t want to try to make that connection, and that’s fine — but there are so many movies being made where you’re told what to think every step of the way. It’s not that important for me."

What is important to Korine is something that goes beyond the usual filmmaking process. Don’t look for him to pull a David Gordon Green, for example, and direct a mainstream stoner comedy.

"What I like is making things. I like to film things and put them together, whether they’re like movies or features or essays or clips. Movies are what I love, but in some ways there’s too much focus on everything being features. Sometimes it’s nice to see things that are just moments. Sometimes, in 30 seconds, I can feel more than I do in 30 hours," he explained. "I always felt like, in movies, they waste so much time getting to the good part, and resolving after the good part. I was just like, why can’t you make movies that consist only of good parts?" *

Governor touts green businesses in SF

The Environmental Defense Fund’s San Francisco office hosted Gov. Arnold Schwarzenegger today to recognize five California companies and a host of green business practices identified in a new EDF report called “Innovations Review: Making Green the New Business as Usual.”

The EDF said the purpose of the report was to identity business innovations that are good for both the environment and a company’s bottom line. They said they hope other companies will consider emulating these green practices.

Schwarzenegger said the companies being recognized have realized that “business as usual was changing” and starting doing things such as powering headquarters with renewable energy, running shuttle buses to cut down on the number of employees commuting to work and implementing communications systems that use a fraction of the energy of normal equipment.

Schwarzenegger said that about a third of the more than 50 companies discussed in the report are based in California and said, “We are inspiring other states, and we are inspiring the country.”

Democrats can’t wait

Green Party presidential candidate Cynthia McKinney gave a stirring speech in New York City on Friday that serves as an important reminder of the simmering populist cauldron that the Democratic Party has neglected at its peril. Much of the country blames Democrats almost as much as Republicans for this country’s fall from grace, marked most prominently by the Iraq War, empowerment of corporations over individuals, and short-sightly hawkish approach to everything from foreign relations to illegal drugs.

I publicly criticized Matt Gonzalez for joining Ralph Nader’s presidential campaign and for offering barbed critique of Barack Obama (comments even our crosstown rival found newsworthy.) And I still believe that Obama can’t be perfectly progressive in his Senate votes or searing in his critique of this country’s direction and still be elected president in the current media and political climate of the country.

Yet I agree with most of what Gonzalez and Nader say, and with the stances being taken by the new standard-bearer of their old party, McKinney. None can win, and they may do more harm than good this year, but their political critiques are right, and they represent a significant segment of this country that isn’t going away. In fact, it may just get stronger and more belligerent once the significant challenges this country faces become President Obama’s problem.

So Democrats, from Pelosi and Obama on down, had better think about how they’re going to address the points that McKinney — the former Democratic member of Congress — makes in the following speech, which I include below in its entirety. Because the people won’t be be patient much longer, particularly if things continue getting worse under a Democratic president who isn’t willing to challenge this country to finally live up to its rhetoric.

Sub Pop pops the cork on two decades with NW fest

‘Member when you first heard Nirvana’s Bleach (1989)? ‘Member when you first spun 1986’s Sub Pop 100? Yeah, it was the ’80s, and college-alternative-indie-whatever-rock was a piping hot, tumescent, rich vein, ready to bedazzle. Still, the lil’ label from the Northwest, Sub Pop, stood out from the slew of worthies with its prescient picks from a roused, riled, and increasingly loud underground, a wise-acre attitude, and a forward-facing outlook on the state of the rock.

So gather round as the Seattle imprint celebrates its 20th anniversary – yeesh, it’s been that long – with a fine comp, Happy Birthday to Me: Terminal Sales Vol. 3 (including tunes by Mudhoney, Foals, Wolf Parade, No Age, Kelley Stoltz, Flight of the Conchords, and the Helio Sequence); a series of reissues begining with Mudhoney’s Superfuzz Bigmuff: Deluxe Edition (coming May 20); a limited relaunch of the lauded Sub Pop Singles Club; a July 11 comedy show with Eugene Mirman and Patton Oswalt; and a benefit fest, which runs July 12-13 at Marymoor Park outside Seattle in Redmond, Wash.

JROTC must go now

OPINION In November 2006, San Francisco made history when the school board made this the first big city in the nation to ban JROTC [Junior Reserve Officer Training Corps]. The board’s resolution, which called for phasing out JROTC from high schools this June, stated that “JROTC is a program wholly created and administrated by the United States Department of Defense, whose documents and memoranda clearly identify JROTC as an important recruiting arm.”

A poison pill was added to the resolution at the last minute: it called for a task force to be set up to find an “alternative” program to JROTC. The school district administration, in a particularly despicable move, set up the task force with more than 10 members supporting JROTC, and only one member opposed.

Surprise! After sitting for almost a year, the task force failed to come up with an alternative, so the school board rolled over and, except for two courageous members — Mark Sanchez and Eric Mar — voted last December to extend JROTC for another year.

In 2005, San Franciscans passed Proposition I by almost 60 percent, declaring it “city policy to oppose military recruiting in public schools.” That same year, by the Army’s own report, 42 percent of JROTC graduates across the nation signed up for the military. As this country enters its sixth year of the illegal occupation of Iraq and Afghanistan, it’s time for the school board to go back to its original decision to kick the military out of our schools.

The school board must end JROTC — now. JROTC is currently scheduled to be “phased out,” but not until June 2009. By then both Sanchez and Mar will be off the school board, and there will be little to prevent the military from orchestrating a vote to extend JROTC indefinitely. If, on the other hand, the school board votes to end JROTC this June as their original resolution required, JROTC would be gone.

Two progressives on the board must be convinced to send the military packing: Kim-Shree Maufas and Green Party member Jane Kim.

Both received endorsements from progressives. To convince them that they risk such endorsements in the future, the JROTC Must Go! Coalition is circuutf8g the following statement: “We will look very closely at the next school board vote on JROTC and will consider the votes carefully when making any endorsements for future candidates.”

Within a week, the Tenants Union, the Harvey Milk LGBT Democratic Club, and the San Francisco Bay View newspaper signed the statement. If Maufas and Kim join Sanchez and Mar, we’ll make history again.

The Bike Issue: Getting in gear

1. City Hall has a bike room. For a while I thought only a scant number of city employees rode to work because the racks out front are usually pretty barren. Then I came across a storage room in the basement, near the café, full of bikes. What an encouraging sight. It was opened a few years back by the Department of the Environment, which is tasked with many of the city’s greening chores, and is available for all City Hall employees to park their rides safely inside.

2. More than 50 percent of San Francisco’s greenhouse-gas emissions come from transportation. Despite this, 20 percent of San Francisco residents polled in November 2007 by David Binder Research said riding a bike did nothing to curb global warming. Au contraire. Bicycles emit zero greenhouse gases (although the rider emits some carbon monoxide from huffing and puffing). A car produces roughly 20 pounds of CO2 for every gallon of gas burned. Gas stations in San Francisco sell about 953,000 gallons of fuel a day. At $4 a gallon, it would take about five months’ of fill-ups to buy every San Franciscan a $750 bicycle — and that’s a nice bike.

3. Someday when you’re waiting for a BART train, take a good look at a system map. It has almost every East Bay bike trail detailed, and many of the trails connect BART stations with recreation areas. "There are a lot of great ways to get out to nature from BART," said BART board member Tom Radulovich.

4. BART is getting more bike-friendly. About 15 percent of the 580 trains now have removed seats to create special areas for bikes. (Look for the cars marked "Bicycle Priority Area.") Though some riders would like each train to have an entire car dedicated to bikes (Caltrain’s approach), a BART spokesperson told me that it would be difficult because cars are added and dropped throughout the day to handle fluctuating ridership. Soon more stations will be outfitted with bike lockers, for rent at a couple of pennies an hour with a BikeLink pass (for information, go to www.bikelink.org). Later this year, the Embarcadero Station will be getting an entire storage room (like City Hall’s, and again, partially funded by the Dept. of the Environment.)

5. One BART oddity: That groove running beside the stairs at the 16th and Mission station is to wheel your bike up and down rather than carrying it. Who knew? Not me. It’s a pilot project, so if you use it and like it, let BART know by calling (415) 989-2278 and the transit agency might install some more.

6. A San Francisco Bicycle Coalition (www.sfbike.org) membership provides mad discounts, and not just at bike shops. Get 10 percent off at Rainbow Grocery and 50 cents off beers at Hole in the Wall — and that’s just the beginning.

7. Make sure you write down your bike’s serial number so it’s easier for the cops to track your ride if it gets ripped off (see "Chasing My Stolen Bicycle," 2/13/07, for more on bike theft in San Francisco). How do you find these magic digits? Flip your bike over and copy the number stamped on the bottom bracket where the pedals go through the frame.

8. Distant lands like Larkspur, Mill Valley, and Muir Woods are all much closer when you mix the bike with the boat. Marin has an amazing network of bike paths, and the Marin Bicycle Coalition (www.marinbike.org) has a map that one-ups San Francisco’s. (It shows the direction of the hills, not just the grade.) And … the ferries have bars.

9. DIY is the way forward. The three-class series at Box Dog Bikes (www.boxdogbikes.com), which covers flats, replacing cables, and truing wheels, is cheap and goes into enough depth that I no longer feel like there are certain parts of my bike I’m not supposed to touch with an Allen wrench. Follow it up with a membership to the Bike Kitchen (www.bikekitchen.org), a DIY shop with tools, parts, and people on hand to help you tune your spokes. It also regularly hosts "WTF" nights for girls, queers, and transpeople.

10. Need to know how to find the bike lanes and avoid the hills? Get one of those great bike maps (available at City Hall and at bike shops) when you join the SF Bike Coalition through a free download at www.sfbike.org/download/map.pdf. You can also pick them up at the energizer stations all over town on Bike to Work Day. It will help you find the best routes and navigate groovy spots like the Wiggle, which is the best route from mid-Market Street to Golden Gate Park. If you look along the sides of the streets, you’ll even see the green bike route signs that say "Wiggle." If you get lost, just look for a bike lane, which are well-marked all over town. Or follow all the other bikers.

Poesia

Since my Italian is limited to a few cuss words plus "prego," I was not able to follow the ins and outs of the Italian film being shown, Foreign Cinema–style, on the rear wall of Poesia, a lovely restaurant opened by Francesco D’Ippolito in March in one of the Castro’s most haunted locales. The movie looked like a close relation of The Dick Van Dyke Show, to judge by the costuming and black-and-white cinematography, and it lacked both sound and subtitles — not necessarily a huge loss for Anglophone diners who prefer to keep their attention trained on their dinners and on one another, instead of on the movie’s progress and whether or not the actors are swearing in Italian.

The movies at Foreign Cinema generally include subtitles and are not limited to Italian provenance. In these respects, Poesia is a not-quite-direct descendant of that highly successful, highly atmospheric Mission District restaurant. Nonetheless, the new place’s ancestry is plain. It’s also welcome, and I speak as someone who resists the multimedia antics that make too many restaurants too stimuutf8g to be pleasant these days. Poesia’s second-story digs, across the street from the venerable Midnight Sun, have recently been home to Ararat and La Mooné, a pair of worthy ventures that seemed to get lost in the Castro shuffle. This can happen when people can’t easily find you. A staircase is a slim sidewalk presence for any restaurant. So, sweeten the deal with a movie! Screen it, and they will come.

And if they come hungry, all the better. Poesia’s food is rich in friendly elegance and would be worth seeking out even without a cinematic enticement. It also reminds us that classic Italian cooking doesn’t (on the one hand) need tinkering with but (on the other) does accept flourishes, even California-style ones, without losing its essential honesty. I particularly liked the glasslike slivers of flash-fried green garlic that served as a bed for a trio of arancini ($6), risotto fritters aromatic with a stuffing of smoked mozzarella cheese. Once the arancini were gone, it was as if we’d been transported to the scene of an auto break-in, with shards of translucent green all over the place. The arancini themselves were sensually, addictively creamy, though short-lived. But we found ourselves nibbling at the green garlic as a satisfying coda.

Fennel root (finocchio) has been a player in Roman Jewish cooking for two millennia, and it clearly matters to Poesia’s kitchen too, at least at this time of year, the crest of the season of roots. The bulbs turned up quartered, breaded, and lightly fried ($7) as an appetizer — a kind of frito misto without the misto — and, shredded, in a salad ($7.50) tossed with arugula leaves and mandarin-orange sections and dressed with a blood-orange vinaigrette. Fennel root is often mentioned as an interesting substitution for celery, but these two dishes, whether considered separately or juxtaposed, suggest that it’s far more than a stand-in for a simple staple.

If not finocchio, then radicchio — the claret and white chicory leaves with the bitter edge — which turned up as a bed for a sophisticated seafood salad ($14). The seafood consisted of peeled shrimp, sea scallops, squid, clams, and mussels, simmered in a marinara sauce and laid atop the radicchio, whose leaves had been softened and made less sharp by braising. And since finocchio and radicchio need not be mutually exclusive, the plate (a long and narrow rectangle like a sushi platter) was finished with a salad of intertwined carrot and fennel-root ribbons at the far end.

Veal is among the most ethically problematic of meats — the calves it’s obtained from are largely a consequence of the none-too-pretty dairy industry (only pregnant cows lactate) — but it’s also mild-flavored and sublimely tender and buttery if handled with care. At Poesia the sautéed medallions ($19) were bathed in a pizziaola sauce, a puree of tomatoes charged with garlic, oregano, and hot pepper, and dotted with halves of pitted black olives. The rest of the dish was finished simply, with quarters of roasted new potato and heap of sautéed broccoli rabe, dark green and glistening.

Desserts, like the savory courses, are variations on classic themes. Tiramisù is beyond cliché now, but Poesia’s version ($7) uses Grand Marnier, for a hint of oranginess, and it doesn’t have the typical tiramisù’s sloppy-lasagne-square look but instead resembles a striped lampshade. Cannoli ($7) is more conventional in appearance — a flute of crisped pastry — and is filled with chocolate chip–studded whipped cream, while an honor guard of strawberry slices stand at attention to one side.

The restaurant’s layout remains unchanged from earlier incarnations. There is a bar in a cozy corner, but you can’t watch the movie if you’re sitting at it: bad angle. The dining-room windows still offer a commanding view of a festive block of 18th Street, although the windows’ bareness is disconcerting. People peeking out from on high at passersby prefer a bit of cover, some curtains or drapes or even miniblinds. I speak from some personal experience on this point. Window treatments also relieve starkness, as experienced from inside. But it’s early, and perhaps D’Ippolito will get to such matters at some point.

He’s a busy man, though, working the dining room, supervising the service staff, and offering customers the occasional tutorial in conversational Italian or Italian film history. I tried out a few of my swear words, and they met with nods of approval, even if we both knew we weren’t dealing in poetry.

There’s a strange dichotomy facing bicycling in San Francisco, and it’s spelled out in the San Francisco Municipal Transportation Agency’s "2007 Citywide Bicycle Counts Report," which features a cover photo of Mayor Gavin Newsom and me pedaling up Market Street together on Bike to Work Day two years ago.

That photo, its context, and the information contained in the report tell the story of a city that at one time set the pace for facilitating bicycling as a viable alternative to the automobile. But that city has been passed up since then by cities such as Chicago, New York, Washington DC, Seattle, and Portland, Ore.

San Francisco still has a higher per-capita rate of bicycle use than any major city in the United States, and that number has been steadily rising in recent years, even as construction of new bike facilities has stalled. The report’s survey found a 15 percent increase since the first official bicycle count was conducted in 2006.

"This increase is especially significant when viewed in light of the injunction against the City’s Bicycle Plan. This injunction has stopped the City from installing any new bicycle facilities since June 2006. Despite a lack of improvement or additions to the City’s bicycle route network, cycling use in San Francisco appears to be increasing," the report read.

It’ll take at least another year for city officials to wrap up the environmental studies on the 56 proposed bike projects and get Judge Peter Busch to lift the injunction (see "Stationary biking," 5/16/07). But it’s still an open question whether San Francisco’s three-year hiatus will be followed by the rapid installation of new bike lanes and other facilities.

City officials express confidence, and there are some hopeful signs. Newsom has been focused on environmental initiatives, the MTA has beefed up its bike staff from six full-time slots to nine, advocacy groups like San Francisco Bicycle Coalition are at the peak of their numbers and influence, and all involved say promoting bicycling is a cheap, effective way of reducing greenhouse gas emissions, air pollution, and traffic congestion.

"I’d be very surprised if, within six months after the injunction being lifted, we don’t see a record number of bike lanes striped," said MTA spokesperson Judson True.

Yet there are still political barriers to overcome in a city where cars are the dominant transportation option — and the first barrier is Mayor Newsom. He has yet to show a willingness to back his green rhetoric with policies that actually take space from cars, which many of the bike lane projects will entail.

"I think we have seen this mayor talk big on some environmental problems, but I’ve been disappointed that on transportation, that thinking hasn’t been turned into action yet," said SFBC executive director Leah Shahum, whom Newsom appointed to the MTA board but then removed earlier this year before her term expired, a sign of the complex and largely adversarial relationship between the mayor and bicyclists.

Newsom has been able to avoid tough decisions on bikes and cars for the past two years because of the injunction and the wait for Muni and traffic congestion studies, which are being released throughout 2008. But that’s about to change with the court’s ban on new bike projects slated to end next year. So will Newsom, who may be running for governor at the time, be willing to make controversial decisions that back up all his green talk? It’s an open question.

The common denominator in all the cities that have pedaled past San Francisco in recent years is that they’ve had strong mayors who have embraced cycling and partnered with bike advocates to change the rules of the road, often contracting them to work directly on projects.

"We’re poised for it, but will we act on it?" Shahum said of the potential for a bike boom in San Francisco. "It’s going to be a real test next summer and I think the mayor’s role is crucial."

THE GREEN BUG


Like many big city mayors, Newsom has become enamored of all things green at the same time that he’s trying to manage an overtaxed transportation system. He is pushing for Muni improvements and has voiced support for congestion pricing initiatives that could make driving a car more expensive.

"This trend of big city mayors focused on transportation to deal with environmental problems is spreading, and I think Newsom has caught that bug," Shahum said.

SFBC and other groups have been meeting regularly with Wade Crowfoot, the mayor’s new director of climate change initiatives, to push the bike plan work forward, create an aggressive implementation strategy, and craft new initiatives like the recently unveiled "Healthways" proposal to close down the Embarcadero to cars on summer Sunday mornings, an idea borrowed from Bogotá, Colombia.

It’s a sea change from that ride I took with Newsom two years ago, three days after he vetoed Healthy Saturdays, which would have created another day of car-free roads in Golden Gate Park. He labeled the bike advocates as "divisive," and told me his veto decision was influenced by "people in the neighborhoods who just came out in force in ways that, frankly, I didn’t expect."

Those feelings, held by the half of San Franciscans who use a car as their primary mode of transportation, haven’t gone away. Newsom’s advisers and the MTA staffers working on the Bike Plan acknowledge the political challenges in completing the bike network, which advocates say is an important prerequisite for convincing more people that cycling is a safe, attractive option.

I asked Oliver Gajda, who is leading the MTA’s bike team, whether the 56 projects he’s now working on would be queued up and ready to build once the injunction is lifted. While the technical work will be done, he said that most projects still will require lots of community meetings and negotiations.

"Some of the projects will take a couple years of work with the community, and some will take less," Gajda said. "When you discuss the potential of removing lanes or parking spots, there are lots of different interests in San Francisco that have concerns."

That’s where the rubber meets the road. Yes, everyone wants to see more cycling in San Francisco — Newsom two years ago even set the goal of 10 percent of all vehicle trips being made by bicycle by 2010, a goal that nobody interviewed for this article thinks the city will meet — but is the city willing to take space from cars?

"The public priorities are already correct, but we need political leadership to implement those priorities even when there’s opposition," said Dave Snyder, transportation policy director with the San Francisco Planning Urban Research Association.

Crowfoot said Newsom is committed to creating better alternatives to the automobile.

"The mayor is fully supportive of expanding the bike network and that will involve tradeoffs," Crowfoot said, acknowledging that some projects involve losing lanes or parking spaces to close the bike network’s most dangerous gaps. "To the extent that the bike network continues to be a patchwork, people won’t get on bikes."

But the mayor also has been fully supportive of the Transit Effectiveness Project’s proposal to reform Muni, even though he recently suggested opposition to proposed parking fine increases might mean that some TEP proposals need to be scaled back.

Skeptics also note that Newsom removed Shahum from the MTA and has appointed no one else with connections to the bicycling community since then, even though that body has sweeping new authority under last year’s Proposition A to implement the bike plan and make decisions about which transportation modes get priority and funding.

"I’m pushing for that, and we’ll see what happens," Crowfoot said of his efforts to get a complete bike network going during the Newsom administration’s reign, acknowledging that, "the proof is in the pudding."

ZERO-SUM GAME


San Francisco’s strong bicycle advocacy culture, the creation of lots of new bike lanes between 2000 and 2004, and innovations like Critical Mass and the sharrow (a painted arrow on the road indicating where bikes should safely ride) made this city a leader in the bicycling movement.

Yet it is only in the last few years, when San Franciscans have been sidelined by the injunction, that the movement really gained mainstream political acceptance and begun to make inroads into the dominant car culture of the United States, slowly and belatedly following the lead of European cities like Amsterdam and Copenhagen.

"Interest in bike-friendly policies is surging, along with the growing number of adults who are riding more. Moreover, the movers and shakers of the biking scene are often smart, always passionate, and they believe strongly in what they are doing. Even when such groups are in the minority, they often enjoy significant political success, and they should never be discounted," J. Harry Wray, a political science professor from DePaul University in Chicago, argues in his new book Pedal Power: The Quiet Rise of the Bicycle in American Public Life (Paradigm, 2008).

Jeffrey Miller, executive director of Thunderhead Alliance, a national umbrella organization supporting regional bicycle advocacy groups, told us he’s pleased with the movement’s progress in recent years.

"There’s been an awakening by the decision-makers in both government and businesses that bicycling and walking can solve a lot of the environmental problems we’re facing," Miller said.

He cited Portland, Ore., Chicago, Seattle, Washington DC, and New York as the cities leading the way in prioritizing bicycling and creating systems that encourage the use of bikes, and said he was sad to see the setbacks in San Francisco.

"But advocates in each of those cities will say there’s so much more work to be done," Miller said.

Most of that work centers on changing how drivers and planners think about cities, and especially with those who see the competition for space as a zero-sum game. Miller noted that it’s good for motorists when more people are encouraged to opt for alternate forms of transportation.

"If you just get 10 to 20 percent of the drivers to use those other modes, it frees the freeways up for cars as well," Miller said. "I don’t see why we go out of our way to favor cars over every other form of transportation."

Like many advocates, he said a strong and consistently supportive mayor is crucial to change the priorities in cities.

"We have an executive leader in Mayor Daley who believes strongly that the bicycle is a big part of the solution to our environmental problems," said Rob Sadowsky, director of the Chicagoland Bicycle Federation.

"We have an incredible partnership with the city," he said, noting that the organization often works directly on city contracts to create more bicycle facilities, something that happens in other bike-friendly cities like Portland and New York. But it doesn’t happen much in San Francisco.

"There’s a real sense that we’ve turned a critical corner and things that we’re been fighting for, for years now, are in sight," said Paul Steely White, executive director of Transportation Alternatives in New York. "In the last year, there have been some significant policy advances."

Like Mayor Daley in Chicago, New York Mayor Michael Bloomberg has become a vocal advocate of green transportation alternatives and has been willing to stand firm against displaced drivers.

"Anything you give to cyclists is basically taken away from automobiles," White said, adding that New York officials "have not shied away from taking parking away, or even a lane on Ninth Avenue. And that shows how serious they are."

The problem isn’t just San Francisco’s, but California’s as well. It is the state’s decades-old California Environmental Quality Act that was used to stall the Bike Plan and make bike projects so cumbersome. Sadowsky said bike projects in Chicago are relatively easy to implement, with little in the way of hearings or environmental studies needed.

Oregon laws also helped make Portland a national leader, with a requirement that all new road construction include bike lanes, paid for with state funds. Yet here in the small, 49-mile square that is San Francisco, with ideal weather and a deeply ingrained bike community, many say the city could be on the verge of regaining its leadership role in the bicycle policy.

A poll conducted in November 2007 by David Binder Research found that 5 percent of residents use a bicycle as their main mode of transportation, and that 16 percent of San Franciscans ride a bike at least once a week. Even more encouraging is the fact that most reasons cited for not biking — not enough bike lanes or parking, bad roads, feeling threatened by cars — are all things that can be addressed by smart bike policies.

"If it’s going to happen anywhere, it’s going to happen in San Francisco — as far as making more bicycling a reality," Gajda told us. "I really feel like we’re poised after the injunction to take it to the next level."
