Broke doesn’t mean bored

Eight great ways to have fun in San Francisco for $5 or less

Living on a tight budget and still trying to have fun in San Francisco is a near impossible task. This is an expensive city, thanks to the reality that everyone wants to live in the tiny 49-square-mile cultural oasis — driving up rents and the cost of just about everything else.

Despite its reputation, the city is actually getting slightly more affordable, if ever so relatively. (In 2008 San Francisco actually fell in the rankings of most expensive cities in the U.S. from fourth to fifth.)

Leading the charge toward making the city a more affordable place to have fun are numerous businesses, government-run sites, and co-ops that are trying to survive in the recession themselves — and using big discounts and fun free events to try to lure you in.

Here’s a list of my favorite deals and freebies I’ve found so far for 2010.

CAFÉ ROYALE

Waving the flag high for nightlife in the Trendynob with its curved couches and velvet curtains is the cozy beer and wine bar Café Royale. This late-night venue (it’s open until 2 a.m. Fridays and Saturdays) stages more than 20 nights of free events each month, an eclectic mix of live entertainment that includes jazz bands, Beatles karaoke, book readings, slam poetry, stand-up comedy, and even the odd accordion night. You can dine on small plates and noshables until the wee hours, and wash them down with a robust selection of wines by the glass and creatively yummy Soju cocktails like the Pom Pom and Creamsicle. And for billiards fans, Café Royale has one of the few three-quarter size tournament tables in San Francisco at just 75 cents a game.

COUNTERPULSE

More an arts and culture community hub than just a performance space, CounterPULSE serves as a home and venue for a diverse mix of local artists, dancers, and playwrights to practice and showcase their latest works. A majority of the events at this nonprofit theater (plays, dance performances, as well as classes and workshops) are free. For more elaborate productions that require tickets, CounterPULSE has a wonderful “no one turned away for lack of funds” policy. You can also get in free by donating a few hours of your time to the volunteer usher program.

$5 MOVIE NIGHT

Saving money on going out to the movies used to mean you had to blag your way to a cheap ticket using a long-expired student ID or arrive by lunchtime to save a few bucks on a matinee ticket. The historic Roxie Theater has done away with all of those shenanigans, at least on Monday nights, with cheaper-than-matinee prices ($5) to all films (except for the odd film festival or special screening when regular ticket prices still apply). This stalwart of the Mission District, which recently celebrated its 100th birthday, is an independent art-house theater that shows limited-run art, music, foreign, and documentary films on two small screens.

BART DISCOUNTS AND FREE RIDES

You didn’t think BART — notoriously expensive for commuters — could be the source of cheap events, did you? Well, mybart.org, run by the transit system, lists a calendar of free events that take place close to BART stations. The site also gives you access to an constantly updated bevy of special discounts like two-for-one theater tickets, museum discounts, and heavily-discounted tickets to Warriors and Cal basketball games. For those of you who only respond to free, mybart.org also puts together ticket contests with different prizes each week, like the chance to win one of five preloaded $50 BART tickets.

PIER CRABBING

Hell with Fisherman’s Wharf and its giant crab sign. Forget the pricey crab dinners at local restaurants. You can learn how to be your own crusty crab-fisher, right in the shadow of the Golden Gate Bridge. The National Park Service staffers at the historic Fort Port (built in the 1850s) give free pier-crabbing demonstrations every Saturday morning from March to October. After the class, they’ll even loan you crabbing equipment so you can put your newly-learned skills to the test. Space is limited and advanced reservations are required.

THE HISTORY OF BAY AREA ROCK ‘N’ ROLL

Feeling nostalgic? You can get a taste for the era when the Bay Area and the psychedelic music scene were the center of the rock ‘n’ roll universe at the Museum of Performance and Design’s free history exhibit “Something’s Happenin’ Here: Bay Area Rock ‘n’ Roll 1963-73.” On display at this one-of-a-kind exhibit are the full-size original painting that made in onto the Grateful Dead’s “Anthem in the Sun” album cover, costume pieces worn by stars like Janis Joplin and Sly Stone, and original posters from the Fillmore and the Avalon Ballroom, along with a collection of previously unseen rock photos. Visitors can also listen to rare audioclips and watch vintage film footage they probably never knew existed. Exhibit runs through Aug. 28. It’s free, but the museum suggests a $5 donation.

AMERICAN BOOKBINDERS MUSEUM

If you’re really looking for a blast from the past, check out the free exhibit at this little-known museum. Bookbinding is the art of physically assembling and sewing the pages and spine of a book by hand — a skill that was made essentially obsolete (at least, for the purpose of mass-production) with the dawning of the Industrial Revolution. But the nonprofit American Bookbinders Museum, part of a working bookbindery that still practices this art, documents the history of how books used to be put together with exhibits celebrating the skilled artisans who bound books, samples of vintage papers, and a maze of large and terrifying-looking 19th- and early 20th-century binding and cutting machines (many of which could cut off all your fingers in one go if you stood too close).

SAN FRANCISCO BICYCLE COALITION

Unless you want to walk, there’s really no cheaper way to get around town than on a bicycle. And for the tens of thousands of San Franciscans who use bikes as their main mode of transportation, the Bike Coalition is a co-op knight in shining armor. The advocacy group, whose members successfully fought more than 200 miles of bike lanes in the city as well as bike access on Muni and BART, also puts on and sponsors a handful of events each month such as free urban cycling workshops to help you navigate the city streets safely, themed guided bike rides, and many other bike-friendly events. Membership starts at $35 per year, but many of their events are free for nonmembers or for a $5 donation.

D-STRUCTURE

Owned by former pro skater and X-Games judge Azikiwee Anderson, D-Structure in the Lower Haight blurs the line between retail store, art gallery and performance space in a big way. Every month, this self-described “lifestyle clothing brand culture store” lets local artists take over the space and use the entire store as their canvas. For launch parties, which take place several times each month, the merchandise displays of urban hoodies and t-shirts and hip beanies are pushed to the walls to make room for DJs and events that range from art openings with live painting to indie rock shows, hip hop album release parties and film screenings. And did we mention the open bar? During its nighttime events, most of which are free and open to the public, D-Structure has been known to bring in a truck load of beer; that’s what happened on New Year’s Eve.

Five great happy hours that offer bargain booze — and amazing food deals

BAR CRUDO’S HAPPY HOUR

About the best crudo (and some of the best seafood) anywhere, Bar Crudo’s new digs on Divisadero Street provide ample room for you and your friends. You want to go at happy hour; there’s free food and you can also get sweet deal on what is arguably one of the best seafood chowders around. A creamy bowl rich with fish, mussels, shrimp, squid, potatoes, and applewood-smoked bacon goes for $5 (normally $14). Oysters from British Columbia, Prince Edward Island, and Washington are normally $2.50 each, but only $1 during happy hour. Beer and wine specials rotate, $5 for wine or $3 for beer — and we’re not talking PBR. Bar Crudo is known for a broad selection of Belgian and artisan beers, not to mention some beautiful wines.

SEAFOOD HAPPY HOUR AT SWELL

For happy hour with a touch of class — and an affordable price — you can’t beat Swell, a delightful, under-the-radar crudo/seafood restaurant. The post-work crowd gets $1 oysters — and not just any oysters, but our own local Point Reyes’ bivalves. There’s ceviche with kampachi and butterfish or mackerel bruschetta with garlic-ginger oil ($8 each). For imbibing, sip $6 Bellinis and Kir Royals or $6 glasses of chardonnay, syrah, or rosé.

AVENUE LOUNGE’S FREE BRATS ON SUNDAYS

I’ll give you three words: bacon bloody marys. That alone makes it worthwhile trekking to Outer Sunset’s Avenue Lounge on a Sunday. But it gets better: buy any of the $3 well drinks or draft beers ($5 to upgrade to Belvedere or Hennessy in your cocktail) and they’ll throw in free brats and chips. Yes, you heard right: dogs, beer, and football on the flatscreens for $3. At that price, you could settle in all day.

NAMU’S FREE-FOOD MONDAYS

Monday night is free food night at Namu, the Richmond District’s gem of an Asian fusion restaurant that combines Korean and Japanese cooking techniques with Cali-fresh cuisine. With an order of sake, beer, or glass of wine, you can nibble on what Namu is dubbing “drinking food”: bite-size tapas, skewers, and spreads with Asian flair. If you can’t stay out late on a Monday night, there’s a weekday happy hour from 5-7 p.m.

DOSA ON FILLMORE’S SOUTH INDIAN HAPPY HOUR

This Pac Heights wing of Dosa has the feel of a chic London Indian restaurant, with striking chandeliers and gorgeous Indian-influenced cocktails. The happy hour rocks with a rotating selection of beer (like India’s Kingfisher), wine (maybe a Dona Paula Argentinean malbec) and, yes, those cocktails (how about “Mood Indigo,” i.e., Buffalo Trace bourbon, jackfruit marmalade, Angostura bitters, and a splash of sparkling wine) for a mere $5 each. For the same price, there’s a range of South Indian snacks like cochin calamari sautéed in coconut milk and served with a julienned salad, or a mung sprout salad with fresh lentils, tomatoes, ginger, cucumber, grated coconut, chile, and mustard-seed oil.

How to fight foreclosure

You’ve finally found your dream home, an apartment so well-loved even you can afford it. You settled in, cleaned the carpet, set the mouse traps … and then the eviction notice arrives: your landlord’s been foreclosed on. And the bank that owns the place now wants you out.

It’s happening a lot in this city, where tenants get caught in the financial meltdown through no fault of their own. But don’t panic: in most San Francisco buildings, foreclosure isn’t a legal grounds for eviction. But you’ll have to stand up for your rights.

Here’s what the San Francisco Tenants Union advises:

If you sense your landlord’s at the brink of foreclosure, watch for telltale signs: realtors checking out the property or repairs that go unresolved. Keep in mind that lack of money is no defense for maintaining property, so call the Department of Building Inspections at 415-558-6200 for help with holding property-owners to their repair responsibilities.

Once the eviction notice due to foreclosure arrives, find out if you are covered by rent control. If you aren’t (if your rental was built after 1979 then you definitely aren’t) the bank has the power to evict you within 90 days. If you do have rent control, you have eviction protection. This means the bank can’t evict you or raise your rent.

Unfortunately, the bank might not know that if it’s based outside the city or state. Ignore the letters to vacate and contact the bank of its property agent directly to let them know you have protection. Then file a wrongful eviction petition with the SF Rent Board, which also handles cases from Oakland, Berkeley and West Palo Alto (forms available at the office at 25 Van Ness, SF or online at www.sfgov.org/rentboard).

Rent control or no, landlords can only collect rent on foreclosed properties until the deed of trust has gone to the bank. Determine who has control of your property to avoid paying rent twice. This information is available at the City Assessor’s Office at 415-554-7915. Send letters to the bank and to your landlord saying you have the money but don’t know who to pay. Until you can determine who has control, don’t pay rent.

Avoid check-cashing fees

ATM charges, big old monthly fees, frustrating commercials — oh Lord, save us from these banks! But you can’t live without ’em either — the average unbanked American spends 5 percent of his or her income at the check-casher. In San Francisco, we drop a total of $40 million a year accessing our own money — not to mention how much goes toward money order fees.

Enter the Bank of San Francisco, the mayor’s brainchild that allows city residents to open a checking or savings account for $5 a month or less. The bank is open to those without Social Security numbers as well as residents who have a poor record with accounts in the past. Go to www.bankonsf.org for more information on the program, or keep an eye peeled for one of the 140 participating city banks that have a “Bank on SF” sign in their window. There’s no reason to pay check-cashing fees any more.

Food so cheap, it’s free

Let’s level here: how broke are you? Two-for-one beers and discounted oysters are all well and good for the casually unmonied, but there are times when one needs a real deal on nutrition — like, food that really is free. If we’ve got your number, here’s the Web site for you: www.freeprintshop.org, whose printable calendar lists 20 organizations that dish up meals open to all comers, including Food Not Bombs’ vegetarian dinners, which are served four times a week in U.N. Plaza. Free Print Shop gets the posthumous thumbs-up from Abraham Maslow: the up-to-date info on shelters, mental health, and neighborhood resources in the city has the bottom tier of your hierarchy of needs covered. Inner peace, by donation

It is said that whenever Buddha would speak to an audience that had not yet recognized him as their spiritual teacher, he would first expound on the concept of dana, or giving. If the listeners were unable to grasp this basic principle, he knew they weren’t ready for the Four Noble Truths.

Would that all yoga studios were this enlightened. I mean, $20 for 90 minutes of inner peace?

We are lucky that with a little bit of looking one can find financially accessible ayurveda even here, in the city of yoga-yuppies. Case in point: Yoga to the People, whose beautiful new Mission District studio (and fixture Berkeley location) offers three classes a day by donation, some of them by candlelight and all of them dana approved. Learning to love the rec centers

With free gyms, darkrooms, and play areas, city rec centers may be the athlete (or artist’s) answer to the bum economy

I’ve always though of recreation centers as places where kids took cheap summer camp classes or attended awkward junior high school dances. But these city-funded centers are actually some of the coolest, most affordable, and least appreciated resources any community has to offer — and especially so in San Francisco.

From weight rooms and basketball courts to dance studios, dog parks, and performance-ready auditoriums, SF’s neighborhood centers offer a variety of resources for budget-conscious adults as well as their kids. Use of most facilities is free (or, on rare occasions, costs a nominal fee) and classes and workshops are priced low with a sliding scale and scholarship option.

Why does the city allocate $34.5 million in general fund support to maintain these centers every year? According to Elton Pon, spokesperson for the Recreation and Park Department (which also oversees public spaces like Golden Gate Park and Coit Tower), “they keep the city sane.”

CHINESE RECREATION CENTER

This Nob Hill neighborhood center caters primarily to youth in Chinatown, which is most apparent weekdays after 3 p.m. when its gym areas fill up with teenage boys. But everyone can enjoy volleyball, basketball, and even dance in its indoor gym, outdoor hoops, and mini weight room. The secret to getting some grown-up time? Visit early on weekdays or after 7 p.m.

EUREKA VALLEY REC CENTER

Well-maintained and recently renovated, this Castro District facility is a favorite for its resources and fantastic location (there’s a grocery store right next door, not to mention the full Castro shopping corridor a block away). Parents love that the indoor and outdoor play areas are especially good for toddlers. Dog-owners love the enclosed dog run. Sporty adults appreciate that the basketball court is regularly relacquered, while event planners focus on the auditorium with raised stage and 70-seat capacity. Special bonuses? An LGBT Teen Center and an especially girl-friendly gym scene.

HARVEY MILK ARTS CENTER

Geared more toward artists than athletes, this recently reopened center in Duboce Park is a dream-come-true for creative-leaning folks on a budget. With dark room, dance studio, costume room, meeting spaces, and variety of other opportunities, HMAC is a fantastic and affordable alternative to adult education courses, expensive dance studios, and booked-up theater spaces.

MISSION REC CENTER

This hidden gem, often overlooked by athletes headed to Mission Cliffs, offers everything your K-12 schools did — without the homework or early call-time. Mission Rec provides a weight area, ping pong tables, squash courts, a dance studio (complete with floor-to-ceiling mirrors and enclosed storage space), basketball court, outdoor playground area, and a full auditorium with stage and curtains (and food prep area).

POTRERO HILL REC CENTER

Most people notice the baseball fields first — a full-block expanse of green, grassy oasis in the center of what’s still mostly an industrial area. But this city property also offers a well-maintained indoor basketball court, recently revamped playground, decent tennis courts (though lights rarely work), and a dog-friendly area that notoriously extends to the rest of the park when games aren’t in session. Not feeling sporty? Check out the infamous mural of O.J. Simpson (who apparently used to frequent the park as a kid) or the fantastic view of the city and the bridge from the south/southeast end of the park.

RICHMOND REC CENTER

Catering primarily to the very young and the very old, people in the middle can certainly appreciate this classic neighborhood meeting spot. Play badminton, volleyball, or take advantage of the dance studio (where many city dance programs are held). Or just people-watch: weekdays are great for spying toddlers in the big indoor play area or quieter play-and-craft spot; weekends are when older Asian ping pong masters take over.

UPPER NOE REC CENTER

Newish, bright, and clean, this well-loved and well-funded facility also is one of the few with its own Web site (hosted by friends of the Noe Valley Recreation Center). The bright, shiny spot offers indoor and outdoor basketball courts, a playground, baseball field, tennis court, dog park, and (according to parents-in-the-know), an inordinately nice sandbox. Indeed, this spot is known for being especially good for babies and toddlers. Another bonus? A multipurpose room that can be rented for small events features an A/V system, stage area with upgraded theater curtains, and a large movie screen with a projector.

Clouds and mirrors

Carl Fisher turned a mosquito-plagued, malarial sandbar into Miami Beach, “The Sun and Fun Capital of The World,” in less than a decade — dredging up sea bottom to build the island paradise, an all-American Las Vegas-by-the- Sea, where Frank Sinatra and Jackie Gleason partied and Richard Nixon received two Republican nominations for president. Art Deco hotels lined the beach, bold as Cadillacs, defiant in the path of hurricanes, their confident Modern lines projecting postwar American power. Morris Lapidus, the architect of the Fontainebleau Hotel, understood that the skin-deep city Fisher conjured out of neon and sunshine was a stage for the leisure fantasies of the ruling class. When his iconic Collins Avenue hotel opened in 1954, Lapidus said he wanted to design a place “where when (people) walk in, they do feel ‘This is what I’ve dreamed of, this is what we saw in the movies.'”

For many years in Miami, that movie was Scarface, as Colombian drug lords shot it out in mall parking lots. A shiny new downtown skyline of banks and condos emerged during a recession economy from the laundered proceeds of drug smuggling. Today the cocaine cowboys have all died, or done their time and moved on. Their descendents are selling art.

Art Basel came to Miami Beach in 2002, and the rise of Miami as an international art world capital neatly coincided with the glory days of the housing bubble. According to Peter Zalewski of Condovulture.com, around 23,000 new condo units were built in and around downtown Miami during the Art Basel era — twice the amount built in the 40 previous years. The success of the international art exhibition has inspired a fever dream among city leaders, in which Miami’s skyline and neighborhoods are radically transformed by art world-related real estate development.

Cesar Pelli’s $461 million, 570,000-square-foot Carnival Center for the Performing Arts opened in 2006 in a moribund section of downtown known for its proximity to the faded 1970s-era mall, the Omni. That same year, the Miami Art Museum (MAM) hired as its new director Terence Riley, the former curator for architecture and design at the New York Museum of Modern Art. Heralded in his new city as “the Robert Moses of the new Miami millennium,” Riley initiated the development of Museum Park. This 29-acre complex would be home to new buildings for the Miami Art Museum and the Miami Museum of Science and Planetarium. It was to be built on the site of Miami’s last public waterfront park, Bicentennial Park, long a sort-of autonomous zone for Miami’s homeless residents. While the new MAM is not scheduled for completion until 2013, by 2007, a 50-floor, 200-unit luxury condo development, 10 Museum Park, had already been finished across the street.

Art Basel Miami Beach brings an estimated 40,000 people to Miami each year to look at art, party, and more important, look at celebrities as they look at art and party. The art fair, once dubbed “the planet’s highest concentration of wealth and talent,” generates an estimated $500 million in art sales each year. Yet while Miami leaders seek to present to the world Basel’s image of wealth and glamour, the iconic image of South Florida today has abruptly become the newly built and entirely empty condo development. Zalewski estimates that 40% of the condo units built since 2003 remain unsold. Florida’s foreclosure rate is the second-highest in the nation, and for the first time since World War II, people are leaving Florida faster than they are arriving. Just months before this year’s Art Basel Miami Beach, a New York Times cover story told of the lone occupant in a towering Broward County condo that had gone entirely into foreclosure. As the fair approached, I wondered: can art really save a city like Miami? Or is its reliance on art world money part of the city’s collapse?

ATLANTIS CITY

At this year’s Art Basel, the glitz was, of course, played down, what with the global economic collapse and Art Basel’s main corporate sponsor, top Swiss bank UBS, now the subject of an FBI probe on charges of helping billionaire clients evade taxes. In the weeks before the opening of the fair, it was announced that the legendary UBS free caviar tent would not be open this year. One could not help but notice that the ice sculptures on the beach itself, hallmarks of the recent boom, were gone, already as fabled as the lost city of Atlantis.

Still, the epic “Arts and Power” issue of Miami magazine hit the stands on time, luxurious full-color spreads on oversize glossy pages. Press from all over the world wrote a month’s worth of previews leading up to the event, and on the day of the VIP vernissage, TV news reporters from all continents were there to dutifully record the arrivals of billionaires, celebrities, and fashion models at the Miami Beach Convention Center. As Art Basel Miami Beach 2009 opened, the floor of the convention center was eerily quiet, with hardly a sound except a hushed, determined whisper a bit like paper money being rubbed together. It seemed to me like everyone was doing her or his part, as if the whole art fair was a sort of performance art piece demonstrating the vigor of the free market in dark times.

This murmur ceased completely, and the air filled with the muted clicking of camera shutters, as Sylvester Stallone passed me on the convention floor. Stallone, too, was stoic, his expression hidden by dark sunglasses at mid-day. He stopped next to me and began to talk to TV news cameras about his own paintings on display, presented by the gallery Gmurzynska. Close-up and in person, clumps of the actor’s face, now just inches from mine, seemed to lay inert and dead like the unfortunate globs of oil paint he had arranged on his own canvasses. Pieces of puffy cheek hung limp and jowly under taut eyebrow skin, Botox and facelifts fighting age for control. For a paparazzi flashbulb moment, I thought I saw in Rambo’s sagging face a metaphor for the doomed efforts to prop up a whole failing way of life.

The Miami Beach Convention Center’s 500,000 square feet had been blocked out into booths and concourses that comprised a pseudo-city of art. As a city, it most resembled some parts of the new Manhattan — crowded yet curiously hollowed out and lifeless, under relentless surveillance, full of nostalgia for its former, more vital self. Groundbreaking art that once had the power to shock, move, or startle — Rauschenberg’s collages, Richard Prince’s Marlboro men, Barbara Krueger’s text block barrages — were presented here as high-priced real estate. In the city of art, time stood still; Matisse, de Kooning, and Duchamp had all retired to the same street. A sailor portrayed in a 2009 life-size portrait by David Hockney seemed to gaze wistfully across the hall toward a 1981 silk-screened print of a dollar sign by Andy Warhol. The life-size portraits by Kehinde Wiley felt just like the city in summer, how the radio of every passing car seems to be blasting the same song. A print of a photo of Warhol and Basquiat together in SoHo stood catty-corner to a 1985 Warhol paining of the text, “Someone Wants To Buy Your Apartment Building.”

I wondered if this city of art offered clues as to the kind of city that developers imagined Miami might become.

ART MAUL

Across Biscayne Bay, away from Miami Beach in the city of Miami, the fever dream of art was turning a down-and-out neighborhood in the poorest city in America into an outdoor art mall. Fifteen satellite art fairs and 60 galleries staged simultaneous exhibitions in Miami during the week of Art Basel Miami Beach. Virtually all this art was crammed into about 80 square blocks north of downtown Miami, bisected by North Miami Avenue. The area included Miami’s African American ghetto, Overtown, the warehouse district of the low rent Puerto Rican neighborhood, Wynwood, and the resurgent Miami Design District up to its shifting borders with Little Haiti.

Walking up North Miami Avenue and Northwest Second Avenue the night before the exhibitions began, I could see the usually moribund main drags transforming before my eyes. Warehouses vacant the other 50 weeks of the year were hastily being turned into galleries or party spaces. Solely for Art Basel week, the Lower East Side hipster bar Max Fish had built an exact replica of its Ludlow Street digs in an Overtown storefront. In Wynwood, the paint still appeared wet on a fresh layer of murals and graffiti running up and down the streets.

The modern-day Carl Fisher most perhaps most responsible for dredging this new art world Miami up from the bottom of the sea is Craig Robins. “I transformed the image of my city from Scarface into Art Deco,” is how Robins put it when I talked to him in the Design District offices of his development firm, Dacra. Widely considered to be the person who brought Art Basel to Miami Beach, Robins is, at a youthful 46, the man who perhaps more than anyone embodies the values and tastes of a new Miami where art and real estate have become as inseparable as fun and sun. Robins takes art seriously — he is a major collector of artists like John Baldessari, Elizabeth Peyton, Rirkrit Tiravanija, and Richard Tuttle — and he made his name and fortune by restoring the derelict Art Deco motels on his native Miami Beach during the early 1990s into the international high-end tourist destination now known as South Beach. Today Robins is one of the principal owners of the warehouses in the Miami Design District and Wynwood.

With his casual dress, shaved head, and stylish Euro glasses, Robins could easily fit in as one of the German tourists who flock to the discos on the South Beach that he developed. His offices offer a rotating display of the works of art in his collection. Around the time of Art Basel, his staff had installed many works by the SoCal conceptual artist John Baldessari, in honor of Baldessari’s upcoming career retrospective at the Tate Gallery in London. Robins was friendly and projected a relaxed cool; when I’d met him on the convention center floor and asked for an interview, he gave me an affectionate shoulder squeeze and said, “Call my assistant and we’ll hang, OK?” A few days later, he grinned somewhat impishly when I sat down said, “I notice you sat in the Martin Bas chair,” as if it was a Rorschach test. Honestly, it was the only piece of furniture in the design collector’s office that looked dependably functional.

Not surprisingly, Robins was adept at explaining the art theory behind his development projects, and the ways Dacra is bringing art, design, and real estate together “to make Miami a brand name.” He said he learned from the successful preservation of historic buildings in his South Beach projects that consumers were starting to reject the cookie-cutter commodities of the mall and “starting to value unique experiences” made from “a combination of permanent and temporary things.” On the streets of the Design District and Wynwood, Robins sought to bring together restaurants, fashion showrooms, and high-end retail stores, surrounded by parties, international art shows, and public art. “This gives a richness to the experience of Miami,” Robins said. “That is the content that Miami is evolving toward right now.” I thought of Lapidus, the Godfather of Art Deco, and his quote about the Fontainebleau: In Wynwood, Robins wanted to turn not just a hotel lobby but an entire neighborhood into a place where visitors feel they have entered a movie.

Robins grew more excited as he discussed his vision. “With my work at Dacra, I build communities,” he told me. “When we brought Art Basel here, Miami immediately became recognized as a world-class city.”

Others are skeptical. “Miami will always be an attractive place for people to visit in December, but you can’t graft culture onto a city,” says Alan Farago of the widely read blog Eye On Miami. “It’s a mistaken belief that art can be a totem or a symbol of a great city without there being any substance. Miami will continue to be a pretender because there is no investment in local culture beyond building massive edifices like the Performing Arts Center.”

Indeed, the center — now renamed the Adrienne Arsht Performing Arts Center, in honor of a wealthy benefactor — has become perhaps another in a long line of tragicomic failed improvements for the area. Bunker-like, it has been likened by some architecture critics to an upside-down Jacuzzi. Though 20 years in the making and long heralded by boosters as a building that would instantly make Miami a “world-class city,” the center has operated at a deficit and suffered from poor attendance since its opening. The future of Museum Park suddenly turned cloudy a month before the opening of this year’s Art Basel, when Miami Art Museum director Terrence Riley unexpectedly resigned days after unveiling the architects Herzog and de Meuron’s final model for the new buildings. Riley sited a desire to return to private practice as an architect, but online speculation had it that he already knew cash-strapped Miami would ultimately be unable to raise the money to build the museum.

Farago wonders what would change if the city did have the money. “In Miami on one hand, we have public school teachers using their own salaries to buy art supplies for their students,” he says. “Then we have these one-off art events and a performing arts center that brings us road shows of Rent, Annie, and 101 Dalmatians.”

When I asked Robins what lasting benefits Art Basel provided to the community, he cited a roster of new restaurants opened by star chefs and fashion showrooms. “It encourages people to come down here year-round,” he said. It was clear that Robins was discussing amenities designed for tourists, or for a speculative community of future residents who might be enticed to come to Miami.

I suggested that there were actually two different communities in Wynwood with potentially opposing interests. I told Robins I’d attended a community meeting held by the activist groups Power University and the Miami Workers Center. There, Wynwood residents discussed how their rents had doubled, how the city continued to neglect the facilities at Roberto Clemente Park, and how the increased presence of police escorting the art patrons to the new galleries had made them feel like they didn’t belong in their own neighborhood.

Robins, who had been very loose and calm during the first 45 minutes of our talk, became visibly upset. He launched into a sustained rant. “Well, look, active communities are a good thing,” he said, shaking his head. “But just because a community is active doesn’t mean it is rational. You go and sit in these meetings and half the people are nuts. Half are just there because they are miserable people and they have some soapbox to go and rant about all these things that they think they have some entitlement to attack government about when they never do anything themselves for anyone. I find that 20 percent of these people are totally irrational, mean-spirited people who would never agree with anyone about anything good.”

“What kind of people do you mean?” I asked.

“People who feel disenfranchised! They’re very angry. They have psychological problems and they want a forum to vent. I’m not implying we should stifle democracy — I’m a big believer in it! I’m saying these people should not be taken seriously by enlightened people!”

Robins rose to look at a clock on his desk. Not surprisingly, our time was up. I politely excused myself to the restroom. When I returned it was like no tantrum had ever happened. Robins’ impish grin even returned as I asked him to pose for a photo in front of one of his Baldessari prints. I had him stand in front of Cigar Smoke to Match Clouds That are Different (By Sight/ First Version), a 1972-3 triptych of photos. As the artist looks into a mirror at clouds over his shoulder in the sky, he blows out a mouthful of twisting cigar smoke, trying to match their elusive shape in the air.

GIMME DANGER

Out on the streets of Wynwood, it was still mostly quiet, expectant, but the scene at David Lynch’s art opening gave one a sense of what the coming weekend would be like. Lynch was presenting photos from a book of staged stills he is releasing with a CD of music by Danger Mouse. Hundreds of hipsters, mostly locals, guzzled free booze and gawked when new Miami resident Iggy Pop showed up, shirtless as usual, in a Miami Vice-style blue blazer. As I watched the Godfather of Punk pose for pictures with his arm around Danger Mouse, I thought of the city of art, the Jackson Pollacks and Donald Judds together at last, on the convention center floor. I had the eerie feeling that the Internet had come to life.

I left the opening and walked at random through the streets of Wynwood at 2:00 a.m. While looking at murals and thinking about the changes Art Basel had wrought, I unexpectedly came upon a small street party of people I knew. The side street intersection was lit up like a stage with an enormous floodlight. Street artist SWOON stood high on a scissor lift, painting a mural on a warehouse wall, while below a couple of kids dressed like old tramps wrestled with a big, brown stuffed bear.

The bear split open, and thousands of tiny white particles of stuffing poured out into a warm Miami breeze, swirling high into the air and reflecting the glow from the floodlight. I ran to join the kids, who were now playing and laughing in the sudden snowstorm. A guy I recognized from Brooklyn rode by on a tall bike. Bay Area artist Monica Canilao went careening by on a scooter with no helmet. A cop drove by and smiled and waved. Guys from Overtown with cornrows and gold teeth were laying out a spread of huge chicken legs on a flaming grill. Some punk kids from Brooklyn sat on the curb, drinking beer. A girl in the group laid her head on a boy’s shoulder as they all watched SWOON work.

For a second, I flashed back to the Stallone scene earlier in the day, back on the convention floor. Here, in this intersection, I had found something living and breathing. This could be the real city of art. But I also knew the SWOON mural was commissioned by Jeffrey Deitch. I stood and watched the painting and the dancing and laughing and eating in the fake December snowstorm and contemplated what the city would be like if we all had the free time, resources, and permission to take to the streets and transform the city any way we pleased. Was this a window to a different world where anything might be possible?

Or was it just art?

Mayor Gavin Newsom’s mid-December decision to announce — on YouTube — that he planned to introduce legislation to protect San Francisco renters from foreclosure-related evictions has outraged tenants rights organizations.

They say Newsom is trying to undermine a much stronger bill by Sup. John Avalos that would give thousands of tenants in newer buildings the same protections as tenants in buildings constructed before 1979.

The mayor’s bill is a classic piece of politics — stealing some of the limelight and giving political cover to mayoral candidate Sup. Bevan Dufty, who voted against Avalos’ package but doesn’t want to be seen as anti-tenant.

This way Newsom and Dufty can enthusiastically support a bill that won’t offend as many landlords — while the mayor vetoes a more robust tenant-protection measure.

Dufty’s decision to side with Sups. Michela Alioto-Pier, Carmen Chu, and Sean Elsbernd in voting Dec. 8 against Avalos’ just-cause legislation gave Newsom veto power over a package that would have empowered thousands of renters.

The Avalos legislation seeks to extend just-cause eviction requirements and protections to tenants in units that are not now subject to eviction controls, which includes most residential rental units built after June 13, 1979. That’s when the city’s current rent control law took effect — and as part of a compromise needed to get the votes for that law, its framers agreed to exempt all “newly constructed” housing.

Newsom’s proposal would only protect those tenants from one category of evictions.

While Newsom promised to introduce his counter-proposal Dec. 15, nothing has come from the Mayor’s Office of Housing so far, fuelling suspicions that the legislation is in fact being drafted by Michael Yarne, a former developer who now works for the Mayor’s Office of Economic and Workforce Development.

Asked Dec. 16 if the Mayor’s Office has submitted any tenant protection legislation, mayoral spokesperson Joe Arellano e-mailed the Guardian, “Not yet. Still ironing out a few details.”

‘OUTRAGEOUS’

In his YouTube address, Newsom said he was committed to vetoing the Avalos legislation, which he claimed was “well-intended” but “went too far.”

His alternative, Newsom said, would protect tenants from the “predatory nature of banks” and “other circumstances” related to “macroeconomic challenges.”

Sara Shortt, executive director of the Housing Rights Committee of San Francisco, described Newsom’s play as “outrageous.”

“The mayor is essentially stealing a bill that came out of the community, watering it down and taking credit for other people’s work,” she said.

“Probably the most frustrating part of this is that there was no attempt to work with any of us,” Shortt added.

As Shortt notes, if Avalos’ legislation doesn’t pass, tenants in at least 10,000 rental units that have come onto the market since 1979 will be left without just-cause eviction protection. That means they can be tossed out for almost any reason.

Shortt’s estimate includes 1,900 units at Trinity Place, 113 units at 430 Main St., 308 units at 333 Harrison St., 113 units built by the Emerald Fund in the Castro District, 192 recently completed units at Strata in Mission Bay, 179 units at 1 Polk St., 720 units at 1401 Market St., 52 units at 818 Van Ness Ave., 5,679 units at Park Merced, and 720 units at Archstone, 350 Eighth St.

But her estimate doesn’t factor in the thousands of potential rentals in the pipeline for Treasure Island, the Candlestick Point shipyard development and the old Schlage Lock site.

Facing a mayoral veto and unwilling to leave tenants without any hope, Avalos introduced an amended version of his just-cause evictions package that addressed Dufty’s concerns about unintended consequences during the board’s Dec. 15 meeting.

“Dufty said he was worried that if someone was in the military and was sent to Afghanistan or decided to go to Harvard to finish their master’s and then wanted to return to their apartment, they’d have to pay a relocation benefit,” Avalos legislative aide Raquel Redondiez explained.

So Avalos amended his legislative package to provide an owner the option of giving additional notice in lieu of making relocation payments for owner move-in eviction of a newly converted single-family home or individually-owned condominium, provided the tenant was initially given specified notice of this status.

The amended bill would also allow eviction from a condominium unit with separable title that had been rented by the developer for a limited time prior to sale of the unit, when the developer has given specified advance notice to the renters.

But Dufty still voted against the amended legislation.

Dufty’s legislative aide Boe Hayward claimed the office didn’t cut a deal with Newsom. “We heard Newsom was interested in introducing legislation but we haven’t seen a draft,” Hayward said. “Michael Yarne mentioned it.”

NO DATA

Hayward told the Guardian that part of Dufty’s problem was an absence of data to support advocates’ claims that people in non-rent-controlled units are being evicted without cause.

“I’ve heard anecdotally that this has happened, but I’ve never seen anyone testify that this has happened,” Hayward said.

He also said Dufty wants Avalos to sit down with small property owners and the San Francisco Apartment Association to hear their concerns.

Shortt acknowledged that such data is hard to come by, but noted that this data gap occurs precisely because there is currently no reporting requirement for evictions that occur in buildings built after June 1979.

“For folks in non-rent-controlled units, it’s like the Wild West,” she said. “Landlords can say ‘I want you out’ and they don’t have to give a reason.

“Right now, such evictions are perfectly legal,” Shortt added, noting that part of the benefit of Avalos’ proposed legislation is that these evictions would be tracked and monitored in future.

She said the mayor’s alternative doesn’t address the larger problem. “While foreclosures are a huge piece of the problem, they are not all of it. There is all this new construction going on. And now that the housing market has turned, units that are either being built or temporarily marketed as rentals, not condos. We’re gaining more units without protections. We can’t just turn a blind eye and say there is no problem and wait for a crisis.”

Dufty told the Guardian that he voted Dec. 15 against Avalos’ amended proposal because “small property owners weren’t invited to the table to dialogue. There needs to be more dialogue between tenant advocates and property owners to come to common ground.”

He said owners are already keeping thousands of rent-controlled units off the market and fears they’ll do the same with post-1979 units. “I don’t want to legislate to the extremes and create a ripple effect where post-1979 units are kept off the market. I’m trying to find ways for folks to rent out their units.” Dufty also said he hadn’t seen the mayor’s proposed legislation.

Shortt said she doesn’t understand what Dufty hopes to achieve by convening landlords and tenant groups. “I feel like we’ve made it clear where we’re willing to go on this, and I can’t imagine anything the San Francisco Apartment Association or others might say that would convince us otherwise. Maybe it’s just a torture technique.”

PROTECTING FAMILIES FROM EVICTIONS

Another major tenant protection bill — Sup. Eric Mar’s legislation to protect families from owner move-in evictions — is headed to the full Board of Supervisors in January. The legislation follows what Mar calls “a couple of minor tweaks” during a Dec. 14 Land Use Committee hearing that took place after months of vetting his bill with the public and family, tenant, and landlord advocacy groups.

The bill seeks to protect families with children from eviction through the OMI process, but would preserve the right of a landlord’s family to evict a tenant’s family, Mar explained.

“During these challenging economic times, our city needs to do whatever it can to ensure that our families are able to live and work here,” Mar said. “This legislation will help our city protect one of our most vulnerable populations: families with children.”

During the hearing, Mar observed that San Francisco is the third most expensive county in the nation for renters and that rent-controlled housing, which encompasses about 70 percent of the city’s rental housing stock, contributes to maintaining a balanced city.

“When a rent-controlled unit is vacated voluntarily or through eviction, the landlord can bring the rental property up to current market rate, making these units unaffordable for our working class and low-income families,” Mar said.

Ted Gullicksen, executive director of the San Francisco Tenants Union, said children need to be protected from no-fault evictions.

“San Francisco protects seniors and other vulnerable tenants from no-fault evictions like the so-called owner move-in eviction,” Gullicksen observed. “We see many families with children being evicted in San Francisco, too often resulting in the family being forced to leave the city where their children were born.”

Advocates say the problem is serious. “We see families flee San Francisco every year due to evictions such as owner move-ins,” said Chelsea Boilard, family policy and communications associate at Coleman Advocates for Children.

Representatives for the San Francisco Apartment Association and other landlord groups spoke out against Mar’s proposal, arguing that anyone with children would have a permanent protection and raising similar objections to ones raised in hearings on Sup. John Avalos’ just-cause legislation.

By the meeting’s end, Mar had amended his legislation to address concerns around the definition of “custodial parent,” including the worry that a 19-year-old could sublease a room to a 16-year-old pretending to be the “custodial parent.”

But Sup. Sophie Maxwell came out against Mar’s amended proposal, which is headed to the full board in January at the recommendation of Mar and Board President David Chiu. All three supervisors sit on the Land Use committee.

“I’m not comfortable with a yes on this legislation,” Maxwell said. “I think we need a comprehensive look at our rental laws and what we need to do. Otherwise, we’ll end up with a hodgepodge.” (Sarah Phelan)

Dufty loses the tenant vote

Sup. Bevan Dufty, the first candidate to formally enter the San Francisco mayor’s race, just took a big political hit. By voting against a bill that would have protected tenants from unjust evictions, he’s angered one of the city’s largest and most powerful voting blocs.

The bill, by Sup. John Avalos, was important to the tenant movement. It extends to renters in buildings constructed after 1979 the same protections that the occupants of older buildings enjoy. It’s particularly important now, when so many buildings are facing foreclosure; under city law, foreclosure isn’t a “just cause” for eviction, but some tenants are losing their homes after foreclosure actions anyway.

Dufty has never been a great tenant vote, but this one should have been easy. The Avalos bill doesn’t put any more housing under rent control, or limit rent hikes, or impose any taxes or fees. There’s no direct economic impact on any landlords.

I couldn’t reach Dufty for comment today, but if the Chronicle quoted him accurately, his explanation was pretty weak:

Dufty told The Chronicle he would have supported the legislation had it simply addressed foreclosure-driven evictions. He feared that as drafted, the proposed law “would have too many unintended consequences,” particularly when it comes to condominium owners who want to move back into units that have been rented out. The burden on owners who try to evict on that basis could prove too harsh when it comes to time and money, he said.

The problem with that arugment is that owner move-in has always been a just cause for eviction. The Avalos bill wouldn’t change that. You own a condo, you rent it out and you want to move back in, you can evict the tenant.

The real problem here is what landlords think of as “rent-control creep.” Once you start allowing eviction protections on newer buildings, they fear, the next step might be actual rent controls on those buildings. So they fought against the bill.

The landlords have money, and if they see Dufty as their ally, they may reward him with campaign contributions. But the progressive vote is going to be important in the next mayor’s race, and so far — unless Sup. Ross Mirkarimi or Public Defender Jeff Adachi jumps in the race — the progressives don’t have a clear candidate. And while there will be a lot of issues in the race, this will be a big one, and I think the vote will hurt Dufty.

Of course, that assumes there’s a more pro-tenant candidate — and that’s not clear at this point. The others who are widely mentioned as potential contenders are state Sen. Leland Yee, Assessor Phil Ting and City Attorney Dennis Herrera. Herrera has traditionally declined to comment on issues like this, in part because he’s the city’s chief legal officer and has to defend the legislation and also because city law bars him from endorsing candidates or taking stands on ballot measures. But he told me several weeks ago that if he announces for mayor, he will openly discuss any issues facing the city.

When I called him today, he made the same promise again — then told me that he hasn’t announced for mayor yet, and so is declining to comment on whether he supports the Avalos bill. Ting told me he wasn’t familiar enough with the bills details, although, like Dufty, he said he supports eviction protections for tenants in foreclosed buildings.

I’m still waiting to hear from Yee.

LIT I have a stack of Try magazines on my lap as I write this. The pages are white, marked by the black of letters and photocopied pen marks and the gray shades of color photos or aged pages filtered through Xerox. Some of the pieces in issues are printouts of e-mails, or maps of sites in Oakland going into foreclosure. Others are copied from typewritten pages — or bank receipts. There are numbered lists, unnumbered lists, exquisite corpses, poetic critiques of programs, hidden sonnets for the public, and mash notes from poet to poet. There are images of Peter Lorre, and images by Dean Smith. One of my favorite poems in Try is "Flipper Turns 25," by Alli Warren. Another, by Stan Apps, is partly about Big Star. One of my favorite issues has writing about Contempt (1963) and Overboard (1987). Cover stars include one of Jeff Koons’ Michael Jackson and Bubbles sculptures, at least one member of Ralph Eugene Meatyeard’s Crater family, and an erect David Wojnarowicz wearing an Arthur Rimbaud mask. It was in Try that I learned that no book by Jack Spicer is under copyright. The names of the contributors to an issue of Try are usually found on or near the back cover.

SFBG Why Try?

Sara Larsen Working with what you have at hand. Just because we don’t have much money, that doesn’t mean we can’t put out a magazine every two weeks or so. Also, we looked around us one day and realized we are surrounded by brilliant writers and artists. And that all of them really should know what the others are currently working on, that this knowing is generative and produces more work.

David Brazil We’ve seen so many people assume that it’s impossible to get anything done in the arts without institutional support, grants, or other kinds of fundraising. We intentionally designed our project to be as inexpensive as possible to produce and also to be free. We’re trying to give the lie to a whole set of assumptions — both about how something is made, and what it could be for.

SFBG How do you manage to print biweekly/bimonthly? How have Try‘s content and the submissions changed over time (if they have changed)?

DB We usually manage to print by the seat of our pants. There’s invariably some logistical or financial obstacle. We’ve tried to learn the lesson of incorporating setbacks as constraints governing the production of the product — a sort of chance operation. And as it’s turned out, issues we’ve produced in this way have often been far better than what we imagined in the first place.

SFBG The particulars: when did you begin publishing Try, what are your frameworks or structures for it, and how many issues have you done to date? What do you like about the folded 8 1/2 by 14-inch (or 2 by 7-inch) format?

DB We began publishing Try in the spring of 2008 and developed our framework as we went along. We’re in the habit of breaking rules as soon as it becomes apparent that they are rules, but we’ve done every issue staplebound on legal size paper, so that’s become habitual. I’d guess we’ve done 28, but we date them rather than number them, so sometimes even we lose track.

SL The 8 1/2 x 14 paper we fold over to make Try gives a spacious page and it’s easy — every copy store has it.

SFBG Do themes or similarities ever emerge within an issue due to happenstance?

DB As time has gone by and our slush pile has expanded, we’ve gotten into the habit of curating our issues around not themes exactly, but motifs, which can show up in subtle ways. The issues we’re the most proud of end up harmonizing the work of the individual contributors and themselves forming an aesthetic whole.

SL Sometimes we’ll know someone is coming to town to read and we’ll solicit work from them and a number of poets who we think resonate with their work. And we’ll throw in some surprises too — someone unexpected, or someone whose work is totally different from everything else in the issue.

SFBG Have you found out about any writers through their sending work unsolicited?

DB We’ve found many writers this way — and we encourage such submissions!

SFBG Who would you love to receive an unsolicited submission from?

SFBG Do you like photocopiers? What tips do you have for people who want to use them?

DB and SL Man, we fucking love photocopiers. And materiality. What is done by hand. We are not about the Internet. We are about a physical object that contains many people’s work passing hand to hand.

DB My only real advice is, make sure to print a sample set before you run off 100 copies.

SL We are also not opposed at all to people borrowing their friends’ copies of Try, bringing it to the copyshop themselves and making more. Not many people have thought to do this, surprisingly, but we’d love it if they did.

SFBG What are you obsessed with at the moment?

DB Obsolete technologies. Prophecy and the logos. Beethoven’s Piano Sonatas. The contents of our next issue.

SL Quiet reading and writing time. Cooking greens. Study groups.


SFBG Has the experience of putting together and distributing Try changed your view of writing in the Bay Area, and if so, how?

DB We’ve always thought of Try as an attempt to provide a mirror within which a very dynamic writing community may see itself — and, hopefully, be seen by future readers. If anything, we’ve become convinced in the past year that the local scene is even more vibrant and populous than we’d previously imagined, which is very hard to believe.

SFBG What are some of the more enigmatic or strange contributions you’ve received?

DB We’ve received bar reviews, anonymous cartoons, scribbles on napkins, ATM receipts, rejection letters from MFA writing programs, texts in braille, faxes from different time zones … and lots and lots of amazing poetry.

SL We’ve also found on the ground or stuffed in library books drawings or pictures that have become our covers or part of an issue.

SFBG What would you like to see more of in Try?

DB We initially imagined Try as a testing ground for work still underway, or else brand new, provisional, still-to-be-revised — and we’d still love to see more of that kind of writing.

Newsom: support just-cause eviction law

EDITORIAL Mayor Gavin Newsom, reeling from criticism of his disappearing act last week and his failure to quickly reengage with San Francisco, has an opportunity to repair some of his tattered image, particularly among progressives, and mend fences with the majority of the Board of Supervisors. It wouldn’t even require a dramatic or groundbreaking step — all he has to do is agree to sign legislation by Sup. John Avalos extending eviction protections to roughly 20,000 vulnerable San Francisco renters.

The Avalos legislation clears up a lingering loophole in the city’s rent-control ordinance, a leftover piece of a bad deal that tenants were forced to accept when the city first moved to limit rent hikes 20 years ago. Back in 1978, with greedy landlords taking advantage of a housing shortage to jack up rents by astronomical rates, the supervisors and then-Mayor Dianne Feinstein were under immense pressure to pass some kind of control. But the landlord-friendly mayor and at-large elected board were unwilling to do what Berkeley had done across the bay by setting permanent limits on how much landlords could raise prices. Instead, they approved a watered-down measure aimed largely at fending off a tenant initiative that would have gone further.

The deal capped rent hikes — but only for existing tenants, allowing landlords to raise rents whenever a unit became vacant. And, after the real estate industry whined that rent control would cause developers to stop building new housing in San Francisco (a dubious claim if ever there was one), the supervisors agreed to exempt all newly constructed housing (that is, anything built after 1979) from any rent regulations at all.

That housing is still exempt from rent control — and because the rent control law also includes eviction protections for tenants, the post-1979 housing stock is also exempt from those rules.

Most San Francisco tenants enjoy what’s known as "just-cause" eviction rules — that is, you can’t toss a tenant out on the streets without a reason. Failure to pay rent, of course, is legal grounds to send someone packing; it’s also okay to force a tenant out if the owner wants to move in.

But for the roughly 20,000 renters living in newer units, evictions can happen on a landlord’s whim — and one of the most dangerous problems is the lack of protection for people who live in a foreclosed building. Tenants in older, pre-1979 buildings have the right to continue to live in the property, under the same lease or rental agreement, after a sale or foreclosure. The Avalos bill would extend that protection (and the other just-cause protections) to all tenants in the city.

It’s hardly a radical idea — and given the boom in high-end housing construction in this city over the past decade (slowed only by the economic crash), the claim that tenant protections will doom new housing is demonstrably false. It would save vulnerable residents from losing their homes, protect people who live (through no fault of their own) in foreclosed properties, and restore a level of fairness to the local housing market.

The measure will almost certainly get six votes on the board, so the only real obstacle is the threat of a Newsom veto. The mayor should state publicly that he supports the measure and will sign it — which could be the start of a new, more promising chapter in Newsom’s political career.

The Guinness World Record for the largest mobilization of human beings was recently broken when 173 million people demanded that their governments eradicate extreme poverty around the world. But U.S. media barely noted the call and San Francisco’s event had low attendance, suggesting an uphill struggle for the cause in the world’s richest nation.

Millions gathered at more than 3,000 Stand Up, Take Action events in 120 countries Oct. 16-18 in an attempt to put pressure on governments to achieve the United Nations Millennium Development Goals, but less than 30 people gathered on the steps of San Francisco City Hall to support the movement.

Sup. John Avalos was one of the speakers at the event, organized by a coalition of local activist groups and student volunteers. Admitting that he was "expecting it to be a little bigger," Avalos said the event was just the start of what needed to be a much larger movement by the American people.

"There is a strange phenomenon occurring at the moment. It’s as if people are a little bit asleep about the need to be active," Avalos told the Guardian. "Because we have an administration they view as being more supportive of human rights and economic and social justice, people are being lulled into thinking things will just get better."

Standing just a short walk away from the birth place of the United Nations, Avalos bought attention in his speech to the rich history San Francisco has in mobilizing social change. "We do the best to live up to it, but we have a long way to go. Around the world this is the time to uproot poverty — we try to provide a safety net, but it could be stronger."

The Stand Up, Take Action, End Poverty Now! campaign is in its fourth year and is organized by the UN Millennium Campaign in an attempt to raise awareness of the Millennium Development Goals (MDGs), a series of benchmarks designed to eradicate global poverty.

At the United Nations Millennium Development Summit in 2000, 189 world leaders promised to "end poverty by 2015." The eight goals include eliminating extreme poverty and hunger, achieving universal primary education, and combating HIV/AIDS, malaria, and other diseases.

Rep. Barbara Lee (D-Oakland) has authored or coauthored every major piece of legislation dealing with global HIV/AIDS issues since she was elected to Congress. She told the Guardian that MDGs must be placed in context with poverty in America. "Sometimes people argue that we must look after our own first, but my position is that if you look at the eight Millennium goals, they all apply to our own country too," Lee said. "Look at the plight of people who are disproportionately affected by HIV/AIDS in our country — especially in African American and Latino communities.

"With the economic downturn, poverty rates in America are soaring, putting more people into circumstances the MDGs focus on outside of America," she continued. "I think it really is important to make those connections."

Lee compared the foreclosure crisis and lack of regulation in the financial markets over the last eight to 10 years to the "wild West" and calls America’s 47 million uninsured a "moral disgrace."

"It is about priorities and political will, and this will be determined by the voices of people saying it must be done," she said. "People have to push for these changes and remember that it didn’t just stop with the election. We have to raise awareness while at the same time working on changing policy. Otherwise we can get stuck debating issues and not doing the work that has to be done to change these very deplorable conditions."

Sup. David Campos was the only other supervisor to speak at the Civic Center event. He said he is committed to the fight against global poverty and wants to see the government represent the values San Francisco was founded on.

"We need to shed light and bring attention to one of the largest issues facing the world today — severe poverty," Campos said. "I really believe that as a city, as a state, and as a country, we not only need to make sure we push the U.S. to follow the lead of other countries, but actually become a leader in making these Millennium goals a reality."

After the event, Campos told the Guardian: "It doesn’t surprise me that more people didn’t show up to the event. But part of the task is to spread the word. San Francisco has been a leader in a number of these issues in the past, and I think we should play a key role in this one."

Campos said that one solution might be to put forward a resolution before the Board of Supervisors to support MDGs and have the city take a formal position on it.

"It is definitely something we are talking about to demonstrate San Francisco’s commitment to the issue," he said. "A lot of people don’t know about the goals, or the fact that the U.S. hasn’t really made them a priority. We need to spread the word and let people know this kind of a movement is only going to be a success if people take it upon themselves to play a leadership role."

Brian Webster, a volunteer who organized the SF event, drew attention to the large number of supporters for the MDGs in California. More than 250,000 people have signed up for the One Campaign, a global NGO that partnered with the U.N. Millennium Campaign in the events.

"For campaigners, it is now a matter of trying to join together and identify vast strategies to communicate what needs to be done," Webster said. "We will continue to educate communities, politicians, and civic leaders in what can be done this month, in the next six months, and ultimately, in the next six years."

While the Bush administration rarely mentioned MDGs while in office, many activists believe President Barack Obama’s public recognition of the goals at a recent U.N. summit demonstrates a change in American policy.

"In other countries, there has been more education and awareness about the goals. But here in America, it is almost like we are starting eight years late," said Anita Sharma, the North American director for the U.N. Millennium Campaign. "President Obama has said that the MDGs are American goals and has even talked about his plans for achieving them."

Also, despite the low numbers at the San Francisco event, Sharma says more than 190,000 people from North America participated in last weekend’s campaign, an increase of more than 70,000 from last year’s attempt.

"It’s not like Americans don’t care about global poverty — in fact we give more in charitable contributions than any other country in the world," she said. "It just takes quite a lot to get Americans into the streets and mobilized. There needs to be more education out there, that’s all."

Ananya Roy, a UC Berkeley professor of city and regional planning and education director of the Blum Center for Developing Economies, says she doesn’t think MDGs can be achieved worldwide by 2015. Even so, she stressed the important role they played in the framework of development.

Speaking at UC Berkeley’s Stand Up and Take Action Event, she said: "The goals are important because they are seen as a new global social contract that makes issues of poverty and inequality quite urgent. They also come with measurements and targets, which is meant to create accountability."

Roy placed particular emphasis on the eighth goal: building a global partnership for development. She noted that that increased awareness can change the ways the U.S. and European governments operate in terms of aid and trade.

"This multilateral contract requires more than simply the action and leadership of the U.S. and Western Europe," she said. "We need to think about poverty and inequality that is immediately around us, understand how we are involved in the production of depravity, and then we must act in solidarity.

"We need to be thinking about poverty as it exits here in the U.S. and not just as an abstract problem that belongs to someplace else," she added. "It is also our problem."

According to a 2009 U.N. report, progress toward achieving the MDGs has been slow in some cases and certain achievements have been reversed by the economic downturn. The report estimates that there will be 55 million to 90 million more people living in extreme poverty than anticipated before the crisis.

For Chandler Smith, media coordinator for the One Campaign — which campaigns for better development policies and more effective aid and trade reform — the Guinness certification marks progress toward achieving the MDGs. "That this year is breaking another world record speaks to the power of people to organize around the world, shows that we are a global community, and that there is a sustainability in the movement," he said.

"As for the North American aspect, we are always trying to educate people more about these issues. Our results show that a lot of our work has been done — but that we also have more work to do."

Park life — and 3,000 guitars

MUSIC Golden Gate Park has once again become a nexus for huge music concerts. The massive scope of events such as Outside Lands can’t help but evoke the legacy of San Francisco in the 1960s, when musical gatherings were not only abundant, but a definite inspiration behind concerts elsewhere — especially Woodstock. With West Fest, organizer Boots Hughston and an extensive lineup of musicians and participants are paying tribute to Woodstock’s 40th anniversary. But they’re also bringing a sense of living history to a place where new generations of music lovers — some of whom knowingly or unknowingly admire contemporary acts influenced by the Woodstock era — regularly congregate.

Politically speaking, it’s especially important to bridge a sense of then and now. One person who will be doing exactly that is David Hilliard, former chief of staff in the Black Panther Party, author of many books, and current-day teacher. "Our purpose was always to ensure that art was part of our revolutionary political process," says Hilliard. "I dispatched members of our chapter to Woodstock ’69 as a gesture of solidarity to the counterculture movement. We were the comrades of the hippies and yippies and Peace and Freedom Party. We had the support of people like John Lennon — that was our constituency. It makes sense that we should be included in a celebration of this momentous event."

Hilliard has no problem connecting his message to the present — especially because the present includes some tell-tale problems. "I have to talk about the contemporary issue of millions of people who have lost their homes to foreclosure," he says, when asked about the subjects of his West Fest speech. "And isn’t it ironic that universal health care is the chief issue of the day, because we were devoted to free health care — it was central to our program."

Hilliard isn’t especially inspired by contemporary hip-hop, aside from Talib Kweli and a few other conscious artists. When asked whether the music of the moment approaches the political intensity of hip-hop’s Public Enemy era, he answers with a "hell no" that is as strong as it is quick, adding, "The whole industry has been reduced to a few artists who make it because they come up with songs about the latest dance."

This doesn’t mean that Hilliard and his contemporaries don’t have a hand in politicizing popular culture and youth culture in ways big and small. Black Panther Minister of Culture Emory Douglas currently has a solo exhibition at the Museum of Contemporary Art in Los Angeles, and Hilliard takes part in projects like the South L.A. Road to College, which teaches South Central L.A. youth about the Panthers and their history while preparing them for college. HBO is developing a six-hour series on the Panthers based on Hilliard’s 1993 book This Side of Glory and Elaine Brown’s 1992 autobiography A Taste of Power: A Black Woman’s Story. "We are proud to be working with Carl Franklin," Hilliard says, referring to the series’ director, whose undersung 1992 classic One False Move renders in truly disturbing human terms the kind of drug violence that 1994’s Pulp Fiction treats as entertainment. "We need a year to tell this story [in a series], but we’ll take six hours and hope that it will inspire people to tell the story more often."

West Fest’s wildest musical element has to be an attempt to outdo the Guinness World Book of Records‘ current entry for Largest Guitar Ensemble via a 3,000-or-more-guitar rendition of Jimi Hendrix’s "Purple Haze." A chief force leading this effort, the producer and musician Narada Michael Walden, is also performing a set in honor of Hendrix later in the day. "Jimi Hendrix was the highest-paid performer at Woodstock, the most sought-after at the time," Walden points out from his base at Tarpan Studios in San Rafael. "A lot of the music he played at the festival — "Jam Back at the House," "Villanova Junction," "Isabella," "Fire" — is in obscurity because we only hear "Purple Haze" and "Foxy Lady." I wanted a chance to play some of the songs Jimi played at Woodstock that we don’t get to hear."

Moreover, working with musicians such as Vernon Ice Black, Hendrix’s bassist Billy Cox, and some special guests, Walden hopes to tap into the political subtext of Hendrix’s music at West Fest. "He didn’t just want white fans or black fans, he wanted to reach everybody," Walden says. "He tried his hardest by doing "The Star-Spangled Banner" in a way in which you heard the bombs exploding. He’d been a paratrooper jumping out of airplanes, and he wanted our nation to wake up to what we were doing, all the needless killing in Vietnam."

If anyone can corral 3,000-plus guitarists into making something musical, it’s the energetic Walden. He’s the producer behind the hits that made Whitney Houston and Mariah Carey into stars, and before that, the gorgeous pop R&B songs by teenage Stacey Lattisaw ("Let Me Be Your Angel," "My Love") that no doubt inspired those divas-to-be to work with him. "My first solo album [Garden of Love Light] in 1976 was produced with Tommy [Tom] Dowd," he remembers, when another legendary musical force who turned away from the U.S. military is mentioned. "I spent months and months recording with him and learned first-hand from him. He was really here to do what he did — only a few people understood how to compress music for radio in a way that it could still live and breathe. He knew how to take the queen of soul, Aretha, and give her a Southern sound with a vibrancy that allowed all people everywhere to feel it. That’s the genius — not just the musical side but the scientific side — of Tom Dowd."

The life stories of men such as Hendrix and Dowd — who abandoned atomic work on the Manhattan Project for the studios of Atlantic Records — are still applicable today. After all, this is an era in which Barack Obama calls for more troops in Afghanistan and wins the Nobel Peace Prize. Amid the potential and contradictions invoked by such a circumstance, Walden’s Hendrix-inspired endeavors and Hilliard’s speech at West Fest are worth hearing.

SF vs. Frank Lembi

One of San Francisco’s largest and most notorious landlords and the many shell corporations under his control have been withholding money from their tenants, the banks that financed their rapid real estate acquisitions, and even San Francisco’s public treasury.

But while the banks have acted, seizing property from the delinquent borrowers, city officials have let Skyline Realty, CitiApartments, Lembi Group, and related corporations stonewall the city and pay far less property taxes than they should have owed, depriving city programs of hundreds of thousands of dollars.

The various corporations run by real estate mogul Frank E. Lembi (who has not returned our calls seeking comment) have earned a terrible reputation in San Francisco, even as they’ve expanded their rental property holdings in recent years.

An award-winning, three-part Guardian series ("The Scumlords," March 2006) documented how the companies used intimidating goons and an arsenal of nefarious tactics meant to drive out low-income tenants from rent-controlled units, prompting City Hall hearings and an ongoing lawsuit against the enterprise by the City Attorney’s Office.

Then, earlier this year, many tenants joined a class action lawsuit against the Lembi enterprises, alleging the landlords have been illegally withholding deposits from departing tenants as a routine business practice, even after admitting that the tenants were entitled to full refunds (see "CitiApartments once again accused of mistreating tenants," Politics blog, July 15).

Attorneys for the firm Seeger Salvas LLP filed the complaint, which tells several appalling stories, including that of Joy Anderson. When Anderson went to retrieve the deposit she was owed, CitiApartments employees allegedly threatened her in front of her eight-year-old son, telling her that if she wanted her money back, she should talk to a lawyer.

Yet in that lawsuit and the one filed by City Attorney Dennis Herrera, which deals with harassment of tenants and other business practices that the city contends are illegal, Lembi’s empire has refused to cooperate, employing a variety of delay tactics. The city’s lawsuit has been stuck in the discovery process for years.

A court filing by the city alleges Lembi’s enterprise has participated in "well over a year of discovery gamesmanship." New counsel for the defendants has promised to speed things up, but Herrera told us it is still an ongoing battle. "It has been incredibly hard to get documents and information in this case. He’s been stonewalling us," Herrera told the Guardian.

Seegar Salvas attorney Brian Devine said six defendants named in his complaint didn’t respond to discovery requests and were found to be in default by the judge, meaning they basically opted not to contest their culpability. Meanwhile, 75 other defendants did respond but haven’t turned over any documents to the plaintiffs, dragging out the discovery process.

"It’ll take sometime for anything to happen," Devine told us. "There’s no Matlock moment where it all comes to a head. There are a lot of procedures to go through."

And apparently the Lembi enterprises know a little something about how to use legal and bureaucratic procedures to hang onto their money for as long as possible, judging from how they’ve worked the process to avoid paying the full amount of property taxes on their holdings.

At last count, there were 13 property foreclosure lawsuits pending on Lembi properties because he couldn’t pay the loans. The banks have seized many of his properties and started selling them off. But while the banks are getting their due, the Assessor’s Office and city taxpayers seem to be getting stiffed.

Lembi has been on the radar of city officials for quite awhile, but he is still managing to avoid getting some of his recently purchased properties reassessed, according to a Guardian investigation of city records. For example, one Lembi-controlled corporation — Trophy Properties X — snatched up a Russian Hill parking garage for $4.7 million in 2007.

Under Proposition 13, that property should have been reassessed when it was purchased, but it wasn’t. The current taxable price tag on the property is still slightly more than $443,000, a gap that costs the city upwards of $50,000 a year in taxes.

In general, property is reassessed at fair market value when there is a change in ownership, increasing the taxes owed on the property. According to the California Board of Equalization, the purchase price is the basis for reassessed value in most cases, although officials can also take into account comparable sales and other factors to increase value even more.

Yet nearly three years later, this property still hasn’t been reassessed.

Assessor-Recorder Phil Ting told the Guardian the reason for the delay is because Lembi hasn’t been cooperative in providing the information needed to do a reassessment. We obtained an October 2007 letter sent out by the Assessor’s Office requesting Lembi’s limited liability corporation provide information on the acquisition of the property and statistics on the garage itself. That letter and others went unanswered.

Common sense suggests that the sale price be used to reassess the garage and be done with it. Yet Ting said he fears that using that price would result in an inaccurate reassessment, which in turn might screw up the amount of taxes the city could ultimately collect. Then again, simply waiting on the unresponsive Lembi enterprise has resulted in less taxes being collected on the parking garage last year and again this year, according to public tax records.

"We try to get it right the first time. If we don’t get it right the first time, then oftentimes it creates a lengthier appeals process and a much lengthier, more adversarial [relationship] between us and the taxpayer," Ting said. "We absolutely don’t want to reassess that property too low because of Prop. 13. You only get one chance, so you have to be high."

Ting told us that the only recourse he has with an uncooperative taxpayer like Lembi is to reassess using information from similar properties in the same area. Once this is done, the negligent taxpayer can either agree with or challenge the new market value, a move that would switch the burden to Lembi. But that wasn’t done for the Russian Hill parking garage.

"That’s the only recourse we have, meaning that we can’t fine them; we can’t subpoena them; we can’t force them to give us the information," Ting said. "By law, they’re supposed to give us the information. But there are no real enforcement powers behind it."

According to Section 480 of the Revenue and Taxation Code, the assessor does have an option and can levy a penalty if a property owner fails to file a change in ownership statement, which can be up to 10 percent of the taxes due on the newly appraised value.

Several other Lembi-controlled properties have been reassessed recently after a delay, including 19,650-square-foot apartment building down the street from the parking garage at 2238 Hyde St. Before the reassessment, the property was valued at a little over $1 million. The current value is $11.7 million, which amounts to a tax bill of more than $137,000 this year.

Lembi bought the building in December 2005, and the Assessor’s Office got in just under the wire of the four-year statue of limitations for reassessments. Last year the taxes paid on the building came to a little more than $13,000, based on its previous $1 million value.

Then there is the 31,812-square-foot apartment building on 1735 Van Ness Ave. that Lembi bought back in June 2006. According the city records, the taxes paid last year on the property were nearly $48,000 based on a market value of $3.9 million. Recently the building was reassessed with a value of $9.6 million. This year’s taxes amount to more than $114,000. Whether or not the Van Ness Avenue building is a case in which the Lembi Group also withheld information is currently being looked into by the Assessor’s Office.

Yet on the Russian Hill parking garage, Lembi is still getting away with withholding the necessary documents for an accurate reassessment — and time is running out. In a little over a year, the statue of limitations runs out and the city will no longer be able to collect anything from Lembi.

Further complicating the city’s efforts to collect is the fact that some other the properties in question have been foreclosed on.

When the Russian Hill garage and other Lembi properties went back to the banks, the Assessor’s Office looked into what could be done to collect the city’s lost revenue. Its solution: a transfer tax. But that was not an option because the bank held the main mortgage, so it wasn’t considered a change of ownership.

Even though the parking garage and other properties have slipped out of Lembi’s control, he is still responsible for the taxes on them during his period of ownership, according to Ting. But given the experiences of others who have tried to collect money from Lembi, that could be a long, expensive process.

While the Lembi enterprises may be stingy in giving the city and tenants their money, they haven’t had a problem making political campaign contributions. Taylor Lembi, grandson of Frank, gave $500 to Mayor Gavin Newsom’s reelection campaign in 2006, according to public campaign contribution records, although Newsom’s campaign offices returned the money exactly two months later (Newsom’s campaign office didn’t respond to our questions about the contributions or reason for returning it).

Skyline Properties, parent of Skyline Realty, also donated $100 to Newsom’s initial mayoral campaign in 2003, and supported Mayor Willie Brown before that. Lembi continues to be a prominent landlord, the subject of a sympathetic profile by the San Francisco Apartment Association in August 2008.

Yet with lawsuits mounting, the banks foreclosing, and the real estate market slumping, the multigenerational Lembi empire that once controlled more rental units in San Francisco than any other entity appears to be in trouble.

And lest anyone slide under its control unaware, the Lembi empire’s many enemies have organized into a group called CitiStop, supported by groups that include the San Francisco Tenants Union and Pride at Work, which argues that "nothing frightens CitiApartments more than knowledgeable tenants."

When arch-conservative Fox News host Sean Hannity decided to weigh in recently on the contentious — and immensely complicated — issue of California water policy, here’s how he summed it up: "Farmers in California are losing their crops, their land, and their livelihood — all because of a two-inch fish!"

Television viewers were treated to scenes of the Central Valley, showing a lush field of crops — followed by a dusty, withered almond orchard that has been cut off from water exports from the Sacramento-San Joaquin Delta. A news anchor informed viewers that the nation’s most productive agricultural lands were "threatened by a small, harmless-looking minnow called the Delta smelt."

Because a federal judge ordered cutbacks in the amount of water shipped from the Sacramento-San Joaquin Delta to farms in the valley, a farmer explained on camera, growers have fallen on hard times. After showing a long line stretching around a food bank in the tiny agricultural town of Mendota, the newscasters concluded: "It’s fish versus families, and [the government is] choosing the fish."

It’s a dramatic portrayal, and the poor farm laborers who are out of work are truly struggling. But it isn’t the fault of a fish.

The state Legislature is now struggling with a series of bills to address a problem that sometimes seems to defy political solution, while agricultural interests — which consume the lion’s share of the state’s water supply — are campaigning aggressively to secure even more water for irrigation.
But while the political forces battle, an environmental nightmare is being created in the Delta. Years of massive water diversions are putting the San Francisco Bay-Delta Estuary at risk. Massive projects that take freshwater from the delta appear linked to declines in bay and delta fisheries, threatening not just endangered species but California’s salmon fishing industry, which lost more than $250 million last year as a result of declining salmon runs.

Meanwhile, climate models predict that California’s tug-of-war over water will only get uglier as the state is hit with more frequent droughts. As lawmakers scramble to find a solution to the state’s water woes, the challenge isn’t just to balance the needs of families and fish — it’s to steer an increasingly crowded state toward smarter management of shrinking water resources.
"It all comes down to climate change," Lt. Gov. John Garamendi noted in a recent interview with the Guardian. "Everything we know about water in California is going to dramatically change."

Critics say the bills in Sacramento are, at best, a duct-tape-and-baling-wire solution to a problem that could define the state’s economy and environment in the coming decades. "The bills … have been slapped together in such a slapdash way that it’s reminiscent of energy deregulation," said Nick Di Croce, lead author of "California Water Solutions Now," a report produced by the Environmental Water Caucus.

As things stand, much of the problem is inherent in the system. The pumps that export water out of the delta regularly pulverize federally threatened and endangered fish, yet the government agencies that operate them are rarely held accountable. The agency that is supposed to monitor and protect the health of the San Francisco Bay and the fragile delta ecosystem also gets 80 percent of its budget from water sales. And the state water projects regularly promise more water than they can deliver.

THE GREAT SUCKING SOUND

California’s water wars stem from a tricky dilemma: two-thirds of the precipitation falls in the north, while two-thirds of the people live in the drier south. The delta, located primarily in Sacramento and San Joaquin counties, is the heart of the state’s water supply, where the freshwater flows of the Sacramento and San Joaquin rivers and vein-like tributaries converge. It boasts the largest estuary on the west coast of North and South America, providing critical habitat for at least a dozen threatened or endangered species including salmon, smelt, splittail, sturgeon, and others.

The delta is also like a superhighway interchange of water for the state. Two vast plumbing networks — the Central Valley Project, operated by the U.S. Bureau of Reclamation, and the State Water Project, operated by the Department of Water Resources — transport water from delta pumping stations to cities and agricultural operations across the state.

Roughly 5.7 million acre-feet of water was exported annually from the delta in recent years, a high that many environmentalists say is unsustainable. (An acre-foot, or 325,853 gallons, is the amount that covers an acre one-foot deep.) Before the Central Valley Project was constructed in the 1930s, only 4.7 million acres of farmland were irrigated statewide. By 1997, the acres of thirsty cropland had climbed to 8.9 million, converting many areas that were once barren desert into lush green fields. Agribusiness dominates the sector, with some farming operations like agricultural empires, spanning tens of thousands of acres.

As cropland has expanded, so has agriculture’s demand for water. State and federal agencies sell delta water by issuing contracts to water districts, and the water is priced substantially lower for agricultural use. A report issued by the Natural Resources Defense Council suggests that delta water allocation has traditionally gone something like this: "Corporate and agricultural interests demanded more and more water, and the state and federal agencies let them have it."

No one can say just how much rain will fall from the sky in a given year, so stipulations were written into the water contracts to deal with allocation during times of water shortage. Depending on a district’s water rights — a status determined by a combination of seniority and a hierarchy of uses — it may get 100 percent of the amount promised on paper during a dry year, or a mere fraction of it.

But the districts continue to promise water to farmers, and the state continues to promise water to the districts.

This latest round of water wars is exacerbated by the drought, which has sapped water supply in California for three years in a row. The dry spell has led to cutbacks in delta water exports, affecting farms throughout the Central Valley and sending unemployment rates up. The drought was responsible for two-thirds of the roughly 1.6 million acre-feet shortfall in water exports, and the remaining third was withheld by federal court order to protect the endangered Delta smelt.

Making matters worse, many growers in water-deprived places like the Westlands Water District, in the Central Valley between Coalinga and San Joaquin, have recently shifted to permanent crops like almonds and pistachios instead of annual crops that might be more adaptable to unpredictable irrigation supply from year to year. It’s a bad time for the San Joaquin Valley to take a hit. The region is already plagued with high rates of unemployment from a loss in construction work, foreclosure, and other effects of the economic downturn.

HELL IN A HANDBASKET

State Sen. Joe Simitian (D-Palo Alto) put the dilemma simply: "The question is, how do you ensure that two-thirds of the state has a reliable supply of clean water while at the same time acknowledging and addressing the fact that from an environmental standpoint, the delta’s gone to hell in a handbasket over the last five years?" Simitian has taken a leadership role in crafting legislation to reform the broken system.

"I just think that things have come together at this particular time to suggest that there ought to be a sense of urgency about all of this," Simitian added during a recent conversation with the Guardian. "But I worry that inaction is always the default mechanism, and in a conversation such as this one, I don’t think we can afford inaction very much longer."
Right now five bills are pending in Sacramento. Backers say they strive to meet two "co-equal goals" that in the past have proven to be at odds: more reliable delta water deliveries, and a restored delta ecosystem. Simitian’s bill would create a Delta Stewardship Council, a powerful body authorized to approve spending for a new system for moving water through the delta that could include a new version of the much-maligned peripheral canal, a hydraulic bypass diverting freshwater from the Sacramento River around the brackish delta to ship south.

A bill introduced by Assembly Member Jared Huffman (D-San Rafael), who heads the water committee, would require a 20 percent reduction in statewide urban per capita water use by 2020. Other objectives in the legislation are to firm up ecological protections for the delta, reevaluate the state’s system of water rights, and establish new water-use reporting requirements.

"Is there a win-win here? I think there is," Simitian told us. "But only if you look at this from sort of a big-picture, comprehensive standpoint, which is why we’ve got five different bills that seek to make sure there’s a balancing of interests. One of the things we’ve talked about was the co-equal goals of a reliable supply of clean water with delta restoration. And that’s going to require not looking at any one of these issues in isolation, but taking it all together."

Gov. Arnold Schwarzenegger has made it clear that he believes building a peripheral canal is the best plan. Variations of this idea have been proposed since the 1940s, but in 1982, Californians voted it down at the ballot (with an overwhelming majority of Northern Californians voting no).

Some groups perceive this as a water grab for Southern California and agribusiness, and delta interests say it would cripple both delta agriculture and the estuary by increasing salinity levels from seawater and preventing the delta from being flushed out by natural freshwater flows. Cost estimates for that project range from $10 billion to $40 billion.

Schwarzenegger has also threatened to veto any package proposed by the Democrat-controlled Legislature that doesn’t include bonds for new dams (in their current form, the bills do not). A bond bill would require a two-thirds majority, while the proposed water bills would only need a simple majority vote to pass.

"I think it’s helpful for the governor to weigh in and share his opinions," Simitian noted cautiously. "However, I did not think it was helpful for the governor to simply draw a line in the sand."

The proposals are being met with skepticism from all sides. Many environmentalists who’ve gone to battle over water policy issues for years have little faith, saying the proposed Delta Stewardship Council would cater to the governor’s agenda because he would have the power to appoint four out of seven members. They’re concerned that environmental issues will play second fiddle as plans are hatched.

Lloyd Carter, an environmentalist who grew up on a raisin farm in the Central Valley, is suspicious the policy will be weighted toward agricultural interests. "What’s most useful is to think of water as cash," Carter told us. "It starts out as cash in the public treasury, and one little segment goes in and scoops out as much as it can. Agriculture accounts for less than 5 percent of the state’s economy and they use 80 percent of the water."

Agricultural interests and the water districts that serve them, not surprisingly, view water cutbacks as a signal of government failure and are hard-pressed to go along with anything that doesn’t include provisions for new dams and a canal. Rather than recognize limits in the amount of available water, they want new projects that will increase the supply.

The Latino Water Coalition, an organization backed by agribusiness that has put together marches and rallies to protest the water cutbacks, is critical of the proposed package of bills because they say it doesn’t go far enough. "For years there’s been committee after committee, board after board. If the best that the legislature can do is propose a new committee, how can that be a good solution?" asked Mario Santoyo, technical adviser to the coalition. "There are people who don’t have jobs, there’s food that’s not being grown. It’s a human rights issue. There has to be a solution, and it has to be real."

Sarah Woolf, media spokesperson for the Westlands Water District, which is among the most vocal advocates for agricultural water, echoed Santoyo’s view. "If you do not have above-ground and below-ground storage and a peripheral canal, then you don’t have a solution," she told the Guardian. "There’s no point in passing legislation that doesn’t solve the whole problem."

But of course, when there’s not enough water to go around, building more dams and canals isn’t going to solve the whole problem, either.

SELLING WATER THAT ISN’T THERE

Patrick Porgans, a Sacramento-based water policy expert, is critical of the proposed package of bills for a very different reason. "We can’t expect the very government that created the problem to solve the problem, because they are the problem," he says.

Porgans arrived at the Guardian office not long ago dressed in a salmon-colored suit with matching snakeskin belt and shoes. The rail-thin 63-year old walks with a bit of a fragile step, but once he gets talking about water, he’s a bundle of uncontrollable energy. For more than two hours, he held a pair of reporters in thrall as he unpacked and held up big armloads of charts, color-coded graphs, and government documents.

It’s just a sampling from what Porgans calls his "database," and he’s got photos: a storage space piled to the ceiling with file boxes containing thousands of pages of documents. This is his life’s work, and it’s easy to wonder how he even has time to eat and sleep.

In the wake of the 1987-92 drought, his consulting firm, Porgans & Associates, publicized the fact that the Central Valley Project and the State Water Project had pumped more water out of the delta during the dry spell than at any other time in their history of operation. The firm is now suing the government for vioutf8g the Endangered Species Act.

Ask Porgans, and he will tell you that "the peripheral canal is a peripheral issue" because it couldn’t possibly address the underlying shortcomings of the water-policy system itself. He pointed out that 80 percent of DWR’s operating budget is derived from water contracts, and noted that many top officials in water-project agencies arrive through a revolving door from the water districts themselves. There’s a conflict of interest, he said, because the agencies are in charge of both selling off delta water and acting as the stewards of the estuary, a natural resource owned by everyone.

Then there’s the underlying problem of the government having sold off contracts for more water than it could actually deliver, a point Porgans highlighted in his notice of intent to sue. In the years following a drought that struck California in the late 1970s, plans were made to expand water storage for the State Water Project — but they fell through at the last minute. Unfortunately, the limited capacity didn’t slow the sale of water contracts.

From 2001 to 2006 alone, the U.S. Bureau of Reclamation signed more than 170 long-term contracts with water districts around the state, promising to increase significantly water deliveries from the Central Valley Project for the next 25 to 40 years.

"Basically, they oversold the project," said Zeke Grader, executive director of the Pacific Coast Federation of Fishermen’s Associations. "We had all these contracts to deliver all this water, but nobody looked to see how much water there was. More importantly, they didn’t look at the minimums that would be needed to protect the delta."

"The shortages are inherent in the project," Porgans said. A court opinion issued by California’s third appellate district court in 2000, plucked from his database, underscores this point. "DWR forthrightly admits that ‘the State Water Project (SWP) does not have the storage facilities, delivery capabilities, or the water supplies necessary to deliver full amounts of entitlement water,’" Judge Cecily Bond noted, citing a DWR bulletin. "There is then no question that the SWP cannot deliver all the water to which contractors are entitled under the original contracts. It does not appear that SWP has ever had that ability."

Grader puts the blame directly on the water districts. The growers, he said, are "innocent third parties affected by the actions of water districts that should’ve known better" because the water contracts specified from the beginning that there would be less water available during times of water shortage.

"We have nothing but empathy for farm workers who are unemployed," said Barbara Barrigan-Parrilla, executive director of Restore the Delta, a 501(c)3 nonprofit representing delta farmers, fishermen, and environmentalists. "But their leadership told them, go ahead and do it. We’ll get you the water."

Farmers have organized rallies and marches to protest the water cutbacks, angrily putting the endangered delta smelt at the front and center of its campaign. A band of farmers traveled up to San Francisco in recent months, chanting "turn on the pumps!" outside Nancy Pelosi’s San Francisco Federal Building office.

Rep. Devin Nunes, a Republican who represents Tulare County and parts of Fresno County, unsuccessfully tried to convince Congress to waive Endangered Species Act requirements to forego protection of the delta smelt and restore irrigation for struggling farmers. (Nunes even attended a Congressional hearing toting a goldfish bowl containing minnows to play up the fish-vs.-families mummery.) The Latino Water Coalition has been particularly vocal, getting airtime on Fox News and publicly appearing with Gov. Schwarzenegger to call for construction of new dams and a canal to ensure a more reliable water supply.

Carter, the environmentalist watching it all unfold from Fresno, shakes his head at the display. If their campaign is successful, he told us, the state will wind up embarking on expensive infrastructure projects that serve an agribusiness agenda at Northern California’s expense. "There’s a sense of entitlement down here," he said. "They say it’s ‘our water.’ But the rivers in California belong to all the people."

DEAD FISH

A series of studies, court decisions, and a Blue Ribbon Delta Vision Task Force convened by the governor have all found that massive water exports out of the delta pose a tremendous environmental problem, and the delta smelt is a mere indicator of the trouble. Failing to ensure adequate freshwater flows through the delta could spell doom for California salmon runs and sound a death knell for the San Francisco Bay-Delta Estuary. And many contend that building a peripheral canal would be the quickest route to the delta’s demise.

According to data Porgans & Associates has collected, excessive delta water exports are aligned with salmon-population nosedives. The numbers tell a tale: high water exports correlate with dramatic decreases in salmon returns after the fish’s three-year spawning cycle. Conversely, fish populations bounce back following years of reduced pumping.

Delta water exports reached an all-time high of 6.7 million acre-feet in 2005, and three years later, the salmon returns were so low that the commercial salmon harvest was cancelled for the first time. It happened again this year.

While Westlands farmers bemoan what they call a "man-made drought," they’re not the only ones facing job loss due to delta water issues — an estimated $255 million was lost last year as a result of low salmon returns, according to California Department of Fish and Game estimates. A report from the Pacific Institute, an Oakland-based environmental research group, estimates puts farm losses due to water shortages at $245 million as of midsummer 2008.

"This closure is among the nation’s worst man-made fisheries disasters," an NRDC report notes. "It is on par with the loss of Atlantic cod fishery, and its economic impact for the fishing industry is comparable to the losses that followed the Exxon Valdez oil spill."

It’s said that California salmon were so plentiful 70 years ago that farmers plucked them from waterways with pitchforks. Now biologists say those salmon runs that haven’t already been listed as threatened or endangered are in a losing battle with worsening water quality and massive water pumps in the Delta.

An estimated 90,000 juvenile salmon die prematurely each year by being sucked into the heavy-duty pumps, according to a U.S. Bureau of Reclamation and Department of Water Resources study. Sometimes the pumping levels are so high it reverses river flows, causing salmon to swim upstream instead of out to sea. "If you or I go out and shoot an eagle, we’ll go to jail," said Barrigan-Parrilla, from Restore the Delta. "But DWR has no accountability to the Endangered Species Act — they’re grinding up fish."

The salmon also suffer from poor water quality, which environmentalists say is a consequence of the voluminous freshwater diversions. If the freshwater isn’t available to flush out the ecosystem, the negative effects of toxins and pollutants discharged into the Delta are amplified, and the water gets warmer, dirtier, and saltier. The ramifications of salmon decline can ripple along the food chain, putting even southern resident killer whales, which feed heavily on Sacramento River salmon in the ocean, at risk.

The impacts of freshwater diversions aren’t limited to the region’s ecology: delta agriculture is taking a hit, too. The construction of a peripheral canal would "destroy the estuary and shift economic problems from one geographic location to another," said Barrigan-Parrilla. "Agriculture in the southern delta would not make it." South delta farmers have already had to contend with increasing levels of salinity due to the massive freshwater diversions, she says. A homegrown bean festival held every year in Tracy has had to resort to purchasing beans, she told us, because it’s become too salty to grow them.

"The estimates are $10 to $40 billion to build a canal," Barrigan-Parrilla said with a note of disbelief. "We’re going to spend that much money on a project when we have just gutted education and welfare?"

As Sacramento lawmakers pull at the threads of this tightly-wound knot, looming uncertainties are waiting in the wings. For one, the delta’s network of 1,100 miles of earthen levees is under increasing strain due to its age, making it susceptible to failure. In fact, some say a peripheral canal could help prevent levee failure. Meanwhile, climate change is a challenge that can’t be ignored because it will affect overall water supply even as the state’s population continues to climb.

"The science makes it increasingly clear that the current system is unsustainable, Simitian said. The scientists are telling us there’s a two out of three chance that in the next 50 years the whole system will collapse, and that serves neither the delta well nor the two-thirds of the state that relies on delta water." Simitian doesn’t endorse the canal, but told us that the system of water conveyance needs to be changed.

Doug Obegi, staff attorney for the Natural Resources Defense Council, told us that thinking about water supply is just as important as thinking about how to move it around. He pointed out that some Colorado River dams just aren’t filling up anymore. If you build a new dam without managing the water supply, he said, "you have a big hunk of concrete that just isn’t doing anything."

Climate change will reduce the Sierra snowpack, an important natural reservoir, anywhere from 15 percent to 60 percent, according to the Department of Water Resources. The warmer air temperatures will also shift the runoff flows to earlier in the year, making major adjustments necessary. Climate change models also predict worsening drought. Water shortages worse than those caused by the 1977 drought could occur in one out of every six to eight years by 2050, and one out of every three to four years by 2100, according to the department’s study. The change in weather patterns will also increase the likelihood of floods.

Rising sea levels will also bring more saline ocean water into the delta, making it necessary to inject more freshwater into the system to maintain water quality and protect native species.

All told, climate change is expected to reduce overall delta water exports from 7 percent to 10 percent by 2050, and 21 percent to 25 percent by the end of the century — a heavy toll that can’t be managed without smarter water management.

Pending water shortages can be addressed in part with what NRDC calls California’s "virtual river," Obegi said, an aggressive system of water efficiency, waste-water recycling, groundwater cleanup and storm-water management that could yield a potential 7 million acre-feet per year.

As for agriculture, the 800-pound gorilla of water consumption in the state, there’s plenty of room for improvement. A report by the Pacific Institute estimates that annual agricultural water savings — with a combination of strategies like smarter irrigation management, modest crop shifting, and more efficient technology — could save up to 3.4 million acre-feet of water per year. The study strongly recommends avoiding expensive infrastructure projects that will burden taxpayers when the state has more budget-friendly options like targeted conservation and efficiency.

It won’t happen without the political will, however. During a discussion about the bills that are currently being debated in Sacramento, Barrigan-Parrilla said she fears the delta will lose out in the end. It’s hard for her to swallow the whole concept of "co-equal goals," she says, because it amounts to putting the environment, which is owned collectively, on equal footing with the interests of a small group of people who consume the vast amount of the state’s water supply.

"It just doesn’t make sense to me," she says. "You can’t have a reliable water supply unless you take care of the environment first."

It’s been a nasty, ugly discussion this past week or so, and if you want a taste, you can go to the Guardian politics blog and read dozens and dozens of comments attacking Daly, attacking me, attacking progressives in general, and raging about hypocrisy.

Okay, I’m almost done. I want to say a word about hypocrisy. I’m not so into buying foreclosed houses; it does stink of profiting off someone else’s misery. But the banks are the ones doing the foreclosure and eviction, not the buyer.

Which is not the case with Ellis Act evictions and tenancy-in-common purchases/condo conversions. You buy a TIC, you’re evicting someone, some tenant who is not quite as well-off as you. It’s legal, and not everyone who buys a TIC is evil, and I know all the caveats — but nearly all the people who have been attacking Daly (and me) in the online comments I’ve read (and in print articles, witness Michela Alioto-Pier) are supporters of TICs and condo conversions, which they refer to as homeownership opportunities.

Yes: homeownership opportunities. Yes: evictions. I’m not defending Daly here, I’m just saying.

Now then: The thing I’m not done talking about is the constant, implied, and often direct supposition that the suburbs are better places than San Francisco to raise kids. I beg to differ.

I grew up in a suburb, mostly white, mostly middle class. (More middle class than the suburbs today because the middle class was bigger and doctors, plumbers, and factory workers lived in the same subdivisions — but still, pretty homogenous.)

Today’s suburbs are more racially mixed, slightly. But they’re still essentially homogenous.

My kids go to a wonderful public school (McKinley Elementary) where everyone isn’t just like them. Some kids have one parent, or two, or are raised by relatives. Some kids go on nice fancy vacations for spring break, and some kids get their main caloric intake from the subsidized breakfast and lunch. A lot of kids don’t speak English as a first language. And for my son and daughter, they are all classmates and friends.

Yes, Chuck Nevius: Michael and Vivian see homeless people on the streets. Usually we give them money. And we talk, my kids and I, about why there are people who have no place to live, and why it’s important not just to give to charity but to try to change the conditions that allow billionaires to pay low taxes while people sleep on the streets.

And last Friday, Vivian and the other seven-year-old campers at Randall Museum camp (public, city-funded, open to all) finished a two-week session on hip-hop dance with a performance that literally made me cry.

My kids are city kids, San Francisco kids. We kick suburban ass. *

How to recapture foreclosed homes

As the Guardian’s report about foreclosures in San Francisco reveals, they are concentrated in the southeast, where working people and communities of color live, making efforts to recapture these properties and resell them as affordable housing units a worthy endeavor.

But for those who believe buying these properties isn’t the best use of city money in stringent budgetary times, it’s worth looking at what’s happening policy-wise elsewhere in the Bay Area.

Last month, a dozen Democratic U.S senators joined their Republican colleagues to defeat a bill that would have allowed judges to reduce mortgages in bankruptcy courts. President Obama, facing strong opposition from the nation’s surviving banks, did not pressure lawmakers to support the measure, and the Senate killed a plan to spare thousands of homeowners from foreclosure through bankruptcy.

Steven Zuckerman, managing director of the California branch of Self-Help, one of the largest community development financial institutions (CDFI) in the United States, says his organization was deeply involved in supporting that legislation. And he doesn’t buy detractors arguments that lowering mortgages in bankruptcy courts would cause banks to raise other people’s mortgage rates.”

‘The bill only included mortgages that already exist,” Zuckerman, who blames the bill’s failure on the “lobbying of bankers’ associations,” told me.

According to information posted at its website, the North Carolina-based Self-Help has already provided billions in financing to small business owners and nonprofits nationwide in an effort to create and protect ownership and economic opportunities for minorities, women, rural residents, and low-wealth families and communities.

And locally, Self-Help is one of several CDFIs trying to help communities like San Francisco’s southeast sector and North Richmond in the East Bay, which have been hard hit by the recent wave of foreclosures sweeping the area.

”We do have a program and a product that we are trying to make available to groups that work in areas with high foreclosures,” Zuckerman said.

Saving the southeast

When Mayor Gavin Newsom and Sup. Sophie Maxwell convened a task force in July 2007 to figure out why African Americans are leaving San Francisco and how to reverse this trend, the subprime loan market crisis was about to send a shock wave of home foreclosures sweeping through southeast San Francisco.

Hope SF, the promised rebuild of the city’s public housing projects, is underway at a cost of $95 million. The city’s certificates of preference program, giving housing priority to black residents displaced by redevelopment, has been expanded and extended. But little has been done to address the immediate problem.

Instead political leaders have focused on a plan to subsidize Lennar Corp.’s construction of thousands of new condos in the southeast section of the city — the heart of the San Francisco’s remaining African American community — and have done nothing to promote a plan that could convert hundreds of foreclosed homes into affordable for-sale or rental units there, right here, right now.

African American Out Migration Task Force (AAOMTF) members recall warning that the crisis would likely hit San Francisco’s already dwindling black population extra hard. And Sup. John Avalos, who was running for election in District 11, remembers seeing impacts in the Excelsior District as early as 2007.

"I was telling people in early 2007 that this was a problem in District 11, and even real estate people didn’t believe me," recalled Avalos, who is exploring legislation to hold banks accountable and spoke at an ACORN protest in support of Excelsior homeowner Genaro Paed, a Filipino native who just staved off eviction orders pending the outcome of his lawsuit against Washington Mutual concerning what Paed describes as "a predatory loan" secured in 2006.

Avalos also planned to introduce legislation on May 12 that would expand protection of renters, including those in foreclosed homes who are now being evicted by banks.

This isn’t the first time city leaders have studied the African American exodus or ways to prevent low-income and minority households from being preyed upon or displaced. Indeed, this task force’s initial findings, (released last summer after Lennar spent millions to persuade voters to support building 10,000 condos in the city’s southeast) suggests San Francisco’s entire black community is at risk unless proactive and immediate steps are taken.

According to U.S. Census data, the city’s African American population shrank to 6.6 percent of the city’s total population by 2005 (a 40 percent decline since 1990) and will likely slip to 4.6 percent by 2050, according to the California Department of Finance. And these findings were made before the foreclosure crisis heated up.

In 2008 Maxwell and other elected officials convened a Fair Lending Working Group (FLWG) to figure out how to respond to the wave of foreclosures. By year’s end, there were 667 home foreclosures in San Francisco, almost all in the city’s southeast sector.

These numbers sound small compared to Contra Costa County or Oakland, where thousands of foreclosures occurred. And they aren’t big enough to qualify for the first round of President Barack Obama’s National Stabilization Program grants, which were released earlier this year. Based on a census-driven formula, the grants sent $8 million to Oakland and no money to San Francisco.

But with half the city’s foreclosures in the Bayview, home to most of the city’s remaining African Americans, the fact that little has been done to save these homes — or to follow early recommendations to do so — is a gentrification crisis in the making.

Ed Donaldson, housing counseling director at the San Francisco Housing Development Corporation in the Bayview District, served on the FLWG and remembers suggesting a two-tier track. First, take steps to protect renters in places that have been foreclosed and second, buy as many foreclosed properties as possible with the aim of reselling or leasing them as affordable units. While the FLWG liked the renter protection angle, it did not support the foreclosure acquisition program.

"The idea fell on deaf ears," recalls Donaldson, who was disappointed his foreclosure purchase plan didn’t make it onto FLWG’s recent recommendation list. FLWG members include financial institutions such as Wells Fargo, Washington Mutual, and Patelco Credit Union; community-based organizations such as Housing and Economic Rights Advocates, SFHDC, Mission Economic Development Agency; and city agencies. The agency also has received staff support from Assessor-Recorder Phil Ting, the Mayor’s Office of Housing, Treasurer Jose Cisneros and the Office of the Legislative Analyst.

"We’d already seen the spike in foreclosure numbers, so how did these recommendations get pushed out? We need something with teeth," Donaldson said.

SFHDC executive director Regina Davis says she suggested a foreclosure purchase and resale plan as an AAOMTF member and was concerned when she noticed that her recommendation was not included on the list discussed at the April 23 meeting. Billed as a closing-out session, that meeting took place at the San Francisco Redevelopment Agency and was attended by Davis, chair Aileen Hernandez, Redevelopment director Fred Blackwell, the Rev. Amos Brown, Barbara Cohen of the African American Action Network, Tinisch Hollins of the Mayor’s Office of Criminal Justice, and former supervisor and assessor Doris Ward, among others. The AAOMTF is finishing up its work this week.

"I got involved because I believed that in exchange for participation, we would see things done and/or funded. Part of what we want to see are real action items that keep African Americans in San Francisco or bring them back. So we really want this issue to move forward with substance," Davis told the Guardian.

Recognizing that San Francisco is facing massive budget constraints, SFHDC is proposing to borrow $1.5 million from Clearinghouse CDFI, a Los Angeles community development financial agency, to acquire and rehabilitate these foreclosed properties.

Davis’ group would then turn it around and offer residents several options: buy (if the prospective buyer qualifies for the city’s $150,000 downpayment assistance and a $50,000 loan from the California Housing Financing Agency); lease (in which SFHDC sells the home to the buyer but leases the land, making the price affordable), lease-to-own. Or, Davis adds, people could rent the units at affordable rates.

But to make the plan work, SFHDC need the banks to sell the properties AT below market rates. Noting that foreclosed properties are still selling in the Bayview for $400,000, Davis says her nonprofit intends to purchase 100 to 200 homes during a 24-month period at less than $200,000 mark.

Yet Davis remains optimistic about the plan’s chances as SFHDC negotiates with major banks for a 50 percent discount, noting that there is a monthly average of 50 foreclosures in the Bayview-Hunter’s Point, and SFHDC has access to 100 qualified buyers.

Blackwell said the Redevelopment Agency hasn’t developed an initiative or a funding pool to respond to the foreclosures in the city’s southeast sector. But, he said, the agency is looking at ways to apply for National Stabilization Program funds even though "federal guidelines mostly don’t apply well in expensive markets like San Francisco.

"We are engaged in advocacy so San Francisco can take advantage of any federal stabilization funds, but we don’t have an agency-specific proposal," he continued.

"Frankly, I think community-based organizations are the best to do programs like that, especially since there is so much anxiety about the Redevelopment Agency and property acquisition in the southeast," Blackwell added.

He believes that given the city’s current budgetary constraints, the AAOMTF "will likely look for leadership from the Mayor and the Board of Supervisors in cases where members have made recommendations and there is an opportunity to bring in public money."

Blackwell feels the city is still getting its mind around its foreclosure problem. "We’ve been spared the wholesale neighborhood-by-neighborhood devastation that places like Antioch faced," Blackwell said. "So, there wasn’t the same sense of urgency. And there’s a need to look more closely at the data. A lot of the information is based on anecdotes."

Yet the feds seem willing to help if city officials take the initiative. Larry Bush, spokesperson for the U.S. Department of Housing and Urban Development’s regional office, says San Francisco and Oakland could file a joint foreclosure plan application.

"If they can identify 100 homes, they’d be eligible for $5 million," Bush said, noting one snag that could unravel the plan locally. "Foreclosed properties must be vacant for at least six months. And as you know, in San Francisco, foreclosed homes still sell."

Maxwell says the city could do more to confront predatory lenders and enforce tenant rights, as well as developing a plan to buy foreclosed properties. "But in San Francisco it’s an issue because of relatively high prices," she told us.

Yet the city’s high prices are the very problem pushing out low-income residents. African American home ownership actually increased after 1990, even as out-migration among black renters increased. But now, if the foreclosures stand, that exodus will likely accelerate.

Asked if she supports SFHDC’s current foreclosure plan, Maxwell said, "It makes sense to me. If that could be done, it would be optimal."

Myrna Melgar of the Mayor’s Office of Housing says she’s not sure that a foreclosure resale plan would work in San Francisco for folks who bought a couple of years ago, when house prices hit $700,000, only to see house prices fall to around $400,000.

"San Francisco is a very different universe from Detroit," Melgar said. "Properties don’t sit around empty and vacant. They are bought by speculators who are betting that in two or three years, their values will go up. So if we had money to buy these properties, which we don’t, we’d be in competition with the speculators, who have lots of money with no strings attached, and who drive the prices up."

Another difference, Melgar said, is that San Francisco banks are holding onto 50 percent of their foreclosed properties, whereas Antioch banks are only holding onto 22 percent. "We’d like to keep folks in the homes," Melgar said. "But it’s a policy issue related to the reality that we have such limited funds."

‘The end of the goddamn family dog’

Former Bottom of the Hill and DNA Lounge doorperson Greg Slugocki wakes up every morning at 4 a.m. to feed and care for 75 rescued dogs at Milo Sanctuary, one of the largest dog and cat rescue sanctuaries in the country. It’s one-third the size of Golden Gate Park and tucked in the mountains of Mendocino County, north of Ukiah.

Slugocki has worked like a dog since he was hired last November, part of a crew of two who cover 283 acres of mountainous terrain. But it’s something else that has recently made his head spin.

"The rate of animals we’ve had to take because of foreclosures is astronomical," Slugocki said. "I’ve taken more dogs in the last three months than in the last two years."

Milo Sanctuary holds adoptions in Berkeley, Oakland, and San Rafael, and he communicates daily with Bay Area shelters and rescues, which also have reported unprecedented increases in animals reluctantly turned over by their desperate owners.

Slugocki may be in the backwoods of Mendocino County, but he’s not alone in this dilemma. Shelters all over the country are reporting rising numbers of dogs, cats, horses, and all kinds of family pets made homeless by the home foreclosure crisis.

In January, San Francisco Animal Care and Control — the municipal shelter and adoption department obligated to take all animals — documented, for the first time, an unprecedented increase in owner-surrendered animals. The report found that since August 2008, there’s been steady monthly increase in such animals, amounting to a 13 percent average rise since last year. Last month saw the highest number of owner-surrendered animals, with an increase of 35 percent.

Though there may not be a clear, quantifiable way of determining whether those owner-surrendered animals are in fact casualties of the foreclosure crisis, animal rescue folks say there is overwhelming anecdotal evidence that this is the case. "Our rescue partners are stretched," SFACC director Rebecca Katz told the Guardian. "We’re stretched."

Indeed, almost every kennel contains a dog with a tag reading "owner- surrender." Animal Care and Control runs a "no kill" shelter — which means animals are euthanized only if they are too sick to be treated or too aggressive to qualify for adoption — has had to spill some of its new arrivals over into its adoption kennels rather than give all the new arrivals a chance for the owners to reclaim them.

"I’ve been dealing with this shelter for 15 years," said Paley Boucher, founder of volunteer-run Rocket Dog rescue, which saves almost 200 dogs from lethal injection each year. "It used to stand out when you saw a dog that was owner-surrendered. But now almost all of them are." Linda Pope with Nike Animal Rescue Foundation says dogs adopted and returned due to foreclosures is an entirely new phenomenon to the center.

Cat Brown, deputy director of the San Francisco SPCA, reported a rise in owner-surrendered animals. "We feel it’s directly related to the economy," she added. "It’s about people losing their jobs and thinking about what they can give up."

Gary Tiscornia, executive director of Monterey County’s SPCA, says there have been a high number of foreclosure animals and a lack of communication between the shelters and the banks, real estate agents, property inspectors, and other entities that find abandoned animals in vacated homes.

Tiscornia said that Realtors in California have found animals in all kinds of conditions in vacated homes, including rottweillers abandoned with a few bags of food and a tub of water, and a dog left for dead in an empty house. It hasn’t always been the case that such incidents were reported to animal shelters.

The disconnect between corporate entities and shelters has been exacerbated by California laws requiring that inspected property, including animals, be left untouched. A new law that went into effect last month addresses the problem. Assembly Bill 2949 requires anyone who encounters an abandoned animal in a property that has been vacated through lease termination or foreclosure to immediately contact a local animal control agency.

The American Society for the Prevention of Cruelty to Animals (ASPCA) issued a statement on foreclosure animals Jan. 29, offering the following advice to those facing foreclosure or eviction: Check with friends, family and neighbors to see if someone can provide temporary foster care for your pet until you get back on your feet. Make sure pets are allowed — and get permission in writing — if you are moving into a rental property. Contact your local shelter, humane society, or rescue group in advance of moving, and provide your animal’s records to help it get placed in an appropriate home.

To love and lose a home is a hard thing, but to love and lose a home and a furry family member is worse, especially when people don’t know where their pet will end up. "People don’t know what to do," said Boucher, citing an example of a Bay Area woman who kept her dog in the backyard of her foreclosed home long after she had moved, and another of a family that asked the subsequent owners of their foreclosed home to care for their dog.

"We’re perceived as a no-kill city, but that’s just not true," said Boucher, who rescues pit pulls, the most frequently euthanized of all dogs. Like many rescue agents, Boucher disagrees with the standards set by the temperament tests that determine whether a dog is suitable for adoption, arguing that many perfect dogs would not pass the test.

Slugocki also takes issue with temperament tests. "Let’s say I’m a dog that hasn’t eaten for weeks and I get picked up and taken to a shelter and they put down a bowl of food as part of the temperament test. Take it away and see what I’ll do."

"This is a huge disaster, a quiet emergency," Boucher said. "I hope people can open their minds to fostering an animal."

Despite the spike in economy-related homeless animals, Katz says SFACC is still under control, at least for the time being. "We have not seen an increase in euthanasia and we hope not to." About 84 percent of animals that end up at the SF shelter are saved, compared to the depressing national average of 30 percent.

"We do everything we can to save animals’ lives. We reach out to every rescue we know of," Katz said.

But with shelters, rescues, and sanctuaries swamped with a growing wave of owner-surrendered pets, caring for the displaced animals is bound to get tougher, particularly if foreclosure crisis gets worse, as many economists predict. And with budget cuts in the offing in the city, SFACC staff fear cutbacks could drive up euthanasia rates.

Slugocki says his sanctuary has something other shelters don’t: space. He has 283 redwood-adorned majestic acres of it, and he’s willing to take every dog, no matter how many have failed the temperament tests that would guarantee a swift lethal injection at the pound.

"I can take dogs that don’t stand a chance. I can take them crippled, heart worm positive, deaf, blind, you name it," Slugocki said. Half of the 75 dogs at Milo are unadoptable and will live peacefully among the redwoods for the rest of their days. He says he can take up to 1,000 dogs but he’s missing one thing: sufficient staff to build enough dog pens and feed and care for a small city of dogs every day.

"I desperately need volunteers," Slugocki said. "I know there is a crowd of people, that 30 to 60 tattooed, pierced, old rock ‘n’rollers, new Buddhists, lifelong punks who are older and maybe have kids now." For now he’s taking as many dogs as he has pens for and is working 14-hour days to help save the discarded critters of the economic crisis.

"It’s the end of the goddamn family dog," Slugocki lamented. "Nobody who has a dog and has lost a home will ever think about having a dog again."

Herrera weighs in on utility shutoffs

Foreclosures can be tough on tenants, and some people are facing evictions. But even if the bank doesn’t toss you out, the previous owner might have stopped paying the utility bills, leaving you with no electricity.

CIty Attorney Dennis Herrera has weighed in with an opinion (PDF) asserting that it’s illegal to shut off power to a tenant after a foreclosure. PG&E can get fines $1,000 a day for cutting off your power. There’s info there on how you can fight back.

We all have high hopes for the new administration. We’d all like to believe that the recession will end soon, that jobs will be plentiful, health care available to all, and affordable housing built in abundance.

But the grim reality is that hard times are probably around for a while longer, and it may get worse before it gets better.

FREE MUSIC AND MOVIES

For a little extra routine effort, I’ve managed to make San Francisco’s library system my Netflix/GreenCine, rotating CD turntable, and bookstore, all rolled into one. And it’s all free.

If you’re a books-music-film whore like me, you find your home maxed out with piles of the stuff … and not enough extra cash to feed your habits. So I’ve decided to only buy my favorites and to borrow the rest. We San Franciscans have quite a library system at our fingertips. You just have to learn how to use it.

Almost everyone thinks of a library as a place for books. And that’s not wrong: you can read the latest fiction and nonfiction bestsellers, and I’ve checked out a slew of great mixology/cocktail recipe books when I want to try new drinks at home. I’ve hit up bios on my favorite musicians, or brought home stacks of travel books before a trip (they usually have the current year’s edition of at least one travel series for a given place, whether it be Fodor’s, Lonely Planet, or Frommer’s).

But there’s much more. For DVDs, I regularly check Rotten Tomatoes’ New Releases page (www.rottentomatoes.com/dvd/new_releases.php) for new DVD releases. Anything I want to see, I keep on a list and search www.sfpl.org for those titles every week. About 90 percent of my list eventually comes to the library, and most within a few weeks of the release date.

And such a range! I recently checked out the Oscar-nominated animated foreign film, Persepolis, the entire first season of Mad Men, tons of documentaries, classics (like a Cyd Charisse musical or Katherine Hepburn and Spencer Tracy’s catalog), even Baby Mama (sure, it sucked, but I can’t resist Tina Fey).

A music fanatic can find virtually every style, and even dig into the history of a genre. I’ve found CDs of jazz and blues greats, including Jelly Roll Morton, John Lee Hooker, Bessie Smith, Muddy Waters, kitschy lounge like Martin Denny and singer Julie London, and have satiated rap cravings with the latest Talib Kwali, Lyrics Born, Missy Elliott, T.I. or Kanye (I won’t tell if you won’t).

Warning: there can be a long "holds" list for popular new releases (e.g., Iron Man just came out and has about 175). When this happens, Just get in the queue — you can request as many as 15 items simultaneously online (you do have a library card, right?) You’ll get an e-mail when your item comes in and you can check the status of your list any time you log in. Keep DVDs a full seven days (three weeks for books and CDs) and return ’em to any branch you like.

I’ve deepened my music knowledge, read a broader range of books, and canceled GreenCine. Instead, I enjoy a steady flow of free shit coming my way each week. And if I get bored or the novelty of Baby Mama wears off, I return it and free up space in my mind (and on my shelf) for more. (Virginia Miller)

STYLE FOR A SONG

Shhh. The first rule about thrifting, to paraphrase mobsters and hardcore thrift-store shoppers, is don’t talk about thrifting — and that means the sites of your finest thrift scores. Diehard thrifters guard their favorite shops with jealous zeal: they know exactly what it’s like to wade through scores of stained T-shirts, dress-for-success suits, and plastic purses and come up with zilcherooni. They also know what it’s like to ascend to thrifter nirvana, an increasingly rarified plane where vintage Chanel party shoes and cool dead-stock Western wear are sold for a song.

Friendships have been trashed and shopping carts upended in the revelation of these much-cherished thrift stores, where the quest for that ’50s lamb’s fur jacket or ’80s acid-washed zipper jeans — whatever floats your low-budg boat — has come to a rapturous conclusion. It’s a war zone, shopping on the cheap, out there — and though word has it that the thrifting is excellent in Vallejo and Fresno, our battle begins at home. When the sample sales, designer runoff outlets, resale dives, and consignment boutiques dry up, here’s where you’ll find just what you weren’t looking for — but love, love, love all the same.

We’re talking bins, people — bins of dirt cheap and often downright dirty garb that the massive Goodwill around the corner has designated unsuitable, for whatever reason. Dive into said bins, rolled out by your, ahem, gracious Goodwill hosts throughout the day, along with your competition: professional pickers for vintage shops, grabby vintage people, and ironclad bargain hunters. They may not sell items by the pound anymore — now its $2.25 for a piece of adult clothing, 50 cents to $1 for babies’ and children’s garb, $4 for leather jackets, etc. — but the sense of triumph you’ll feel when you discover a tattered 1930s Atonement-style poison-ivy green gown, or a Dr. Pimp-enstein rabbit-fur patchwork coat, or cheery 1950s tablecloths with negligible stainage, is indescribable.

But others, like this Hunter’s Point Goodwill, abound with on-trend goodies. At least until all of you thrift-hungry hordes grab my junk first. Tucked into the corner of a little strip mall, this Goodwill has all those extremely fashionable hipster goods that have been leached from more populated thrift pastures or plucked by your favorite street-savvy designer to "repurpose" as their latest collection: buffalo check shirts, wolf-embellished T-shirts, Gunne Sax fairy-princess gowns, basketball jerseys, and ’80s-era, multicolored zany-print tops that Paper Rad would give their beards for.

Salvation Army, 1500 Valencia, SF. (415) 643-8040, www.salvationarmyusa.org. The OG of Mission District thrifting, this Salv has been the site of many an awesome discovery. Find out when the Army puts out the new goods. The Salvation soldiers may have cordoned off the "vintage" — read: higher priced — items in the store within the store, but there are still plenty of old books, men’s clothing, and at times hep housewares and Formica kitchen tables to be had: I adore the rainbow Mork and Mindy parka vest I scored in the boys’ department, as well as my mid-century-mod mustard-colored rocker.

Savers, 875 Main, Redwood City. (650) 364-5545, www.savers.com When the ladies of Hillsborough, Burlingame, and the surrounding ‘burbs shed their oldest, most elegant offerings, the pickings can’t be beat at this Savers. You’ll find everything from I. Magnin cashmere toppers, vintage Gucci tweed, and high-camp ’80s feather-and-leather sweaters to collectible dishware, antique ribbons, and kitsch-cute Holly Hobbie plaques. Strangest, oddly covetable missed-score: a psychiatrist’s couch.

Thrift Town, 2101 Mission, SF. (415) 861-1132, www.thrifttown.com. When all else fails, fall back on this department store-sized megalith. Back in the day, thrift-oldsters tell me, they’d dig out collectible paintings and ’50s-era bikes. Now you’ll have to grind deeply to land those finds, though they’re here: cute, mismatched, mid-century chairs; the occasional designer handbag; and ’60s knit suits. Low-cost groceries

Maybe you don’t qualify for food assistance programs or you just want to be a little thriftier — in which case the old adage that the early bird gets the metaphorical worm is apropos. When it comes to good food deals, timing can be everything. Here are a couple of handy tips for those of us who like to eat local, organic, and cheap. Go to Rainbow Grocery early and hit the farmers markets late. Rainbow has cheap and half-price bins in the bread and produce sections — but you wouldn’t know it if you’re a late-riser. Get there shortly after doors open at 9 a.m. for the best deals.

By the end of the day, many vendors at farmers markets are looking to unload produce rather than pack it up, so it’s possible to score great deals if you’re wandering around during the last half hour of the market. Then there’s the Grocery Outlet (2001 Fourth St., Berkeley and 2900 Broadway, Oakland, www.groceryoutlets.com), which puts Wal-Mart to shame. This is truly the home of low-cost living. Grocery Outlet began in 1946 in San Francisco when Jim Read purchased surplus government goods and started selling them. Now Grocery Outlets are the West Coast’s version of those dented-can stores that sell discounted food that wasn’t ready for prime-time, or perhaps spent a little too long in the limelight.

Be prepared to eat what you find — options range from name brands with trashed labels to foodstuffs you’ve never seen before — but there are often good deals on local breads and cheeses, and their wine section will deeply expand you Two-Buck Chuck cellar. Don’t be afraid of an occasional corked bottle that you can turn into salad dressing, and be sure to check the dates on anything perishable. The Grocery Outlet Web site (which has the pimpest intro music ever) lists locations and ways to sign up for coupons and download a brochure on how to feed your family for $3 a day. LIVE MUSIC FOR NOTHING — AND KICKS FOR FREE

Music should be free. Everyone who has downloaded music they haven’t been given or paid for obviously believes this, though we haven’t quite made it to that ideal world where all professional musicians are subsidized — and given health care — by the government or other entities. But live, Clive? Where do can you catch fresh, live sounds during a hard-hitting, heavy-hanging economic downturn? Intrepid, impecunious sonic seekers know that with a sharp eye and zero dough, great sounds can be found in the oddest crannies of the city. You just need to know where to look, then lend an ear. Here are a few reliables — occasional BART station busks and impromptu Ocean Beach shows aside.

Some of the best deals — read: free — on world-class performers happen seasonally: in addition to freebie fests like Hardly Strictly Bluegrass every October and the street fairs that accompanying in fair weather, there’s each summer’s Stern Grove Festival. Beat back the Sunset fog with a picnic of bread, cheese, and cheap vino, though you gotta move fast to claim primo viewing turf to eyeball acts like Bettye Lavette, Seun Kuti and Egypt 80, and Allen Toussaint. Look for the 2009 schedule to be posted at www.sterngrove.org May 1.

Another great spot to catch particularly local luminaries is the Yerba Buena Gardens Festival, which runs from May to October. Rupa and the April Fishes, Brass Menazeri, Marcus Shelby Trio, Bayonics, and Omar Sosa’s Afreecanos Quintet all took their turn in the sun during the Thursday lunchtime concerts. All year around, shopkeeps support sounds further off the beaten path — music fans already know about the free, albeit usually shorter, shows, DJ sets, and acoustic performances at aural emporiums like Amoeba Music (www.amoeba.com) and Aquarius Records (www.aquariusrecords.org). Many a mind has been blown by a free blast of new sonics from MIA or Boris amid the stacks at Amoeba, the big daddy in this field, while Aquarius in-stores define coziness: witness last year’s intimate acoustic hootenanny by Deerhoof’s Satomi and Tenniscoats’ Saya as Oneone. Less regular but still an excellent time if you happen upon one: Adobe Books Backroom Gallery art openings (adobebooksbackroomgallery.blogspot.com), where you can get a nice, low-key dose of the Mission District’s art and music scenes converging. Recent exhibition unveilings have been topped off by performances by the Oh Sees, Boner Ha-chachacha, and the Quails.

Still further afield, check into the free-for-all, quality curatorial efforts at the Rite Spot (www.ritespotcafe.net), where most shows at this dimly lit, atmospheric slice of old-school cabaret bohemia are as free as the breeze and as fun as the collection of napkin art in back: Axton Kincaid, Brandy Shearer, Kitten on the Keys, Toshio Hirano, and Yard Sale have popped up in the past. Also worth a looky-loo are Thee Parkside‘s (www.theeparkside.com) free Twang Sunday and Happy Hour Shows: a rad time to check out bands you’ve never heard of but nonetheless pique your curiosity: Hukaholix, hell’s yeah! And don’t forget: every cover effort sounds better with a pint — all the better to check into the cover bands at Johnny Foley’s (www.johnnyfoleys.com), groove artists at Beckett’s Irish Pub in Berkeley (www.beckettsirishpub.com), and piano man Rod Dibble and his rousing sing-alongs at the Alley in Oakland (510-444-8505). THE CHEAPEST WAY TO GET AROUND TOWN

Our complex world often defies simple solutions. But there is one easy way to save money, get healthy, become more self-sufficient, free up public resources, and reduce your contribution to air pollution and global warming: get around town on a bicycle.

It’s no coincidence that the number of cyclists on San Francisco streets has increased dramatically over the last few years, a period of volatile gasoline prices, heightened awareness of climate change, poor Muni performance, and economic stagnation.

On Bike to Work Day last year, traffic counts during the morning commute tallied more bicycles than cars on Market Street for the first time. Surveys commissioned by the San Francisco Bicycle Coalition show that the number of regular bike commuters has more than doubled in recent years. And that increase came even as a court injunction barred new bike projects in the city (see "Stationary biking," 5/16/07), a ban that likely will be lifted later this year, triggering key improvements in the city’s bicycle network that will greatly improve safety.

Still not convinced? Then do the math.

Drive a car and you’ll probably spend a few hundred dollars every month on insurance, gas, tolls, parking, and fines, and that’s even if you already own your car outright. If you ride the bus, you’ll pay $45 per month for a Fast Pass while government will pay millions more to subsidize the difference. Riding a bike is basically free.

Free? Surely there are costs associated with bicycling, right? Yeah, sure, occasionally. But in a bike-friendly city like San Francisco, there are all kinds of opportunities to keep those costs very low, certainly lower than any other transportation alternative except walking (which is also a fine option for short trips).

There are lots of inexpensive used bicycles out there. I bought three of my four bicycles at the Bike Hut at Pier 40 (www.thebikehut.com) for an average of $100 each and they’ve worked great for several years (my fourth bike, a suspension mountain bike, I also bought used for a few hundred bucks).

Local shops that sell used bikes include Fresh Air Bicycles, (1943 Divisidero, www.fabsf.com) Refried Cycles (3804 17th St., www.refriedcycles,com/bicycles.htm), Karim Cycle (2800 Telegraph., Berkeley, www.teamkarim.com/bikes/used/) and Re-Cycles Bicycles (3120 Sacramento, Berkeley, www.recyclesbicycles.com). Blazing Saddles (1095 Columbus, www.blazingsaddles.com) sells used rental bikes for reasonable prices. Craigslist always has listings for dozens of used bikes of all styles and prices. And these days, you can even buy a new bike for a few hundred bucks. Sure, they’re often made in China with cheap parts, but they’ll work just fine.

Bikes are simple yet effective machines with a limited number of moving parts, so it’s easy to learn to fix them yourself and cut out even the minimal maintenance costs associated with cycling. I spent $100 for two four-hour classes at Freewheel Bike Shop (1920 Hayes and 914 Valencia, www.thefreewheel.com) that taught me everything I need to know about bike maintenance and includes a six-month membership that lets me use its facilities, tools, and the expertise of its mechanics. My bikes are all running smoother than ever on new ball bearings that cost me two bucks per wheel, but they were plenty functional even before.

There are also ways to get bike skills for free. Sports Basement (www.sportsbasement.com) offers free bicycle maintenance classes at both its San Francisco locations the first Tuesday of every month from 6:30-7:30 p.m. Or you can turn to the Internet, where YouTube has a variety of bike repair videos and Web sites such as www.howtofixbikes.com can lead you through repairs.

The nonprofit The Bike Kitchen (1256 Mission, www.thebikekitchen.org) on Mission Street offers great deals to people who spend $40 per year for a membership. Volunteer your time through the Earn-a-Bike program and they’ll give you the frame, parts, and skills to build your own bike for free.

But even in these hard economic times, there is one purchase I wouldn’t skimp on: spend the $30 — $45 for a good U-lock, preferably with a cable for securing the wheels. Then you’re all set, ready to sell your car, ditch the bus, and learn how easy, cheap, fast, efficient, and fun it is to bicycle in this 49-square-mile city. (Steven T. Jones)

LOW-COST HEALTH CARE

When money’s tight, healthcare tends to be one of the first costs we cut. But that can be a bad idea, because skimping on preventive care and treatment for minor issues can lead to much more expensive and serious (and painful) health issues later. Here is our guide to Bay Area institutions, programs, and clinics that serve the under- and uninsured.

One of our favorite places is the Women’s Community Clinic (2166 Hayes, 415-379-7800, www.womenscommunityclinic.org), a women-operated provider open to anyone female, female-identified, or female-bodied transgender. This awesome 10-year-old clinic offers sexual and reproductive health services — from Pap smears and PMS treatment to menopause and infertility support — to any SF, San Mateo, Alameda, or Marin County resident, and all on a generous sliding scale based on income and insurance (or lack thereof). Call for an appointment, or drop in on Friday mornings (but show up at 9:30 a.m. because spots fill up fast).

A broader option (in terms of both gender and service) is Mission Neighborhood Center (main clinic at 240 Shotwell. 415-552-3870, www.mnhc.org, see Web site for specialty clinics). This one-stop health shop provides primary, HIV/AIDS, preventive, podiatry, women’s, children’s, and homeless care to all, though its primary focus is on the Latino/Hispanic Spanish-speaking community. Insurance and patient payment is accepted, including a sliding scale for the uninsured (no one is denied based on inability to pay). This clinic is also a designated Medical Home (or primary care facility) for those involved in the Healthy San Francisco program.

Contrary to popular belief, Healthy San Francisco (www.healthysanfrancisco.org) is not insurance. Rather, it’s a network of hospitals and clinics that provide free or nearly free healthcare to uninsured SF residents who earn at or below 300 percent of the federal poverty level (which, at about $2,600 per month, includes many of us). Participants choose a Medical Home, which serves as a first point-of-contact. The good news? HSF is blind to immigration status, employment status, and preexisting medical conditions. The catch? The program’s so new and there are so many eligible residents that the application process is backlogged — you may have a long wait before you reap the rewards. Plus, HSF only applies within San Francisco.

Some might consider mental health less important than that of the corporeal body, but anyone who’s suffered from depression, addiction, or PTSD knows otherwise. Problem is, psychotherapy tends to be expensive — and therefore considered superfluous. Not so at Golden Gate Integral Counseling Center (507 Polk. 415-561-0230, www.goldengatecounseling.org), where individuals, couples, families, and groups can get long- and short-term counseling for issues from stress and relationships to gender identity, all billed on a sliding scale.

Other good options

American College of Traditional Chinese Medicine (450 Connecticut, 415-282-9603, actcm.edu). This well-regarded school provides a range of treatments, including acupuncture, cupping, tui ma/shiatsu massage, and herbal therapy, at its on-site clinics — all priced according to a sliding scale and with discounts for students and seniors. The college also sends interns to specialty clinics around the Bay, including the Women’s Community Clinic, Haight Ashbury Free Medical Clinic, and St. James Infirmary.

St. James Infirmary (1372 Mission. 415-554-8494, www.stjamesinfirmary.org). Created for sex-workers and their partners, this Mission District clinic offers a range of services from primary care to massage and self-defense classes, for free. Bad ass.

Free Print Shop (www.freeprintshop.org): This fantabulous Webs site has charts showing access to free healthcare across the city, as well as free food, shelter, and help with neighborhood problems. If we haven’t listed ’em, Free Print Shop has. Tell a friend.

Native American Health Center (160 Capp, 415-621-8051, www.nativehealth.org). Though geared towards Native Americans, this multifaceted clinic (dental! an Oakland locale, and an Alameda satellite!) turns no one away. Services are offered to the under-insured on a sliding scale as well as to those with insurance.

SF Free Clinic (4900 California, 415-750-9894, www.sffc.org). Those without any health insurance can get vaccinations, diabetes care, family planning assistance, STD diagnosis and treatment, well child care, and monitoring of acute and chronic medical problems.

Haight Ashbury Free Clinics (558 Clayton. 415-746-1950, www.hafci.org): Though available to all, these clinics are geared towards the uninsured, underinsured "working poor," the homeless, youth, and those with substance abuse and/or mental health issues. We love this organization not only for its day-to-day service, but for its low-income residential substance abuse recovery programs and its creation of RockMed, which provides free medical care at concerts and events. THE BEST HOMELESS SHELTERS

There’s no reason to be ashamed to stay in the city’s homeless shelters — but proceed with awareness. Although most shelters take safety precautions and men and women sleep in separate areas, they’re high-traffic places that house a true cross-section of the city’s population.

The city shelters won’t take you if you just show up — you have to make a reservation. In any case, a reservation center should be your first stop anyway because they’ll likely have other services available for you. If you’re a first-timer, they’ll want to enter you into the system and take your photograph. (You can turn down the photo-op.) Reservations can be made for up to seven days, after which you’ll need to connect with a case manager to reserve a more permanent 30- or 60-day bed.

The best time to show up is first thing in the morning when beds are opening up, or late at night when beds have opened up because of no-show reservations. First thing in the morning means break of dawn — people often start lining up between 4 a.m. and 6 a.m. for the few open beds. Many people are turned away throughout the day, although your chances are better if you’re a woman.

You can reserve a bed at one of several reservation stations: 150 Otis, Mission Neighborhood Resource Center (165 Capp St.), Tenderloin Resource Center (187 Golden Gate), Glide (330 Ellis), United Council (2111 Jennings), and the shelters at MSC South (525 Fifth St.) and Hospitality House (146 Leavenworth). If it’s late at night, they may have a van available to give you a ride to the shelter. Otherwise, bus tokens are sometimes available if you ask for one — especially if you’re staying at Providence shelter in the Bayview-Hunters Point District.

They’ll ask if you have a shelter preference — they’re all a little different and come with good and bad recommendations depending on whom you talk to. By all accounts, Hospitality House is one of the best — it’s small, clean, and well run. But it’s for men only, as are the Dolores Street Community Services shelters (1050 S. Van Ness and 1200 Florida), which primarily cater to Spanish-speaking clients.

Women can try Oshun (211 13th St.) and A Woman’s Place (1049 Howard) if they want a men-free space. If kids are in tow, Compass Family Services will set you up with shelter and put you on a waiting list for housing. (A recent crush of families means a waiting list for shelters also exists.) People between 18 and 24 can go to Lark Inn (869 Ellis). The Asian Woman’s Shelter specializes in services for Asian-speaking women and domestic violence victims (call the crisis line 877-751-0880). IMPRESS A DATE WITH DINNER UNDER $50

You’ve got a date this weekend, which you’re feeling pretty good about, but only $50 to spend, which feels … not so good. Where should you go?

You’ll appear in-the-know at the underrated Sheba Piano Lounge (1419 Fillmore, www.shebalounge.com) on lower Fillmore Street, right in the middle of the burgeoning jazz revival district. Sheba was around long before Yoshi’s, offering live jazz (usually piano, sometimes a vocalist) and some of the best Ethiopian food in the city in a refined, relaxed lounge setting. Sure, they’ve got Americanized dishes, but skip those for the traditional Ethiopian menu. Sample multiple items by ordering the vegetarian platter ($13) or ask for a mixed meat platter, which is not on the menu ($16 last time I ordered it). One platter is more than enough for two, and you can still afford a couple of cocktails, glasses of wine or beer, or even some Ethiopian honey wine (all well under $10). Like any authentic Ethiopian place I’ve eaten in, the staff operates on Africa time, so be prepared to linger and relax.

It’s a little hipster-ish with slick light fixtures, a narrow dining room/bar, and the increasingly common "communal table" up front, but the Mission District’s Bar Bambino (2931 16th St., www.barbambino.com) offers an Italian enoteca experience that says "I’ve got some sophistication, but I like to keep it casual." Reserve ahead for tables because there aren’t many, or come early and sit at the bar or in the enclosed back patio and enjoy an impressive selection of Italian wines by the glass ($8–$12.50). For added savings with a touch of glam, don’t forget their free sparkling water on tap. It’s another small plates/antipasti-style menu, so share a pasta ($10.50–$15.50), panini ($11.50–$12.50), and some of their great house-cured salumi or artisan cheese. Bar Bambino was just named one of the best wine bars in the country by Bon Apetit, but don’t let that deter you from one of the city’s real gems.

Nothing says romance (of the first date kind) like a classic French bistro, especially one with a charming (heated) back patio. Bistro Aix (3340 Steiner, www.bistroaix.com) is one of those rare places in the Marina District where you can skip the pretension and go for old school French comfort food (think duck confit, top sirloin steak and frites, and a goat cheese salad — although the menu does stray a little outside the French zone with some pasta and "cracker crust pizza." Bistro Aix has been around for years, offering one of the cheapest (and latest — most end by 6 or 7 p.m.) French prix fixe menus in town (Sunday through Thursday, 6–8 p.m.) at $18 for two courses. This pushes it to $40 for two, but still makes it possible to add a glass of wine, which is reasonably priced on the lower end of their Euro-focused wine list ($6.25–$15 a glass).

FREE YOGA

You may be broke, but you can still stay limber. San Francisco is home to scores of studios and karmically-blessed souls looking to do a good turn by making yoga affordable for everyone.

One of the more prolific teachers and donation-based yoga enthusiasts is Tony Eason, who trained in the Iyengar tradition. His classes, as well as links to other donation-based teachers, can be found at ynottony.com. Another great teacher in the Anusara tradition is Skeeter Barker, who teaches classes for all levels Mondays and Wednesdays from 7:45 to 9:15 p.m. at Yoga Kula, 3030a 16th St. (recommended $8–$10 donation).

HOW TO KEEP YOUR APARTMENT

So the building you live in was foreclosed. Or you missed a few rent payments. Suddenly there’s a three-day eviction notice in your mailbox. What now?

Don’t panic. That’s the advice from Ted Gullicksen, executive director of the San Francisco Tenants Union. Tenants have rights, and evictions can take a long time. And while you may have to deal with some complications and legal issues, you don’t need to pack your bags yet.

Instead, pick up the phone and call the Tenants Union (282-6622, www.sftu.org) or get some professional advice from a lawyer.

The three-day notice doesn’t mean you have to be out in three days. "But it does mean you will have to respond to and communicate with the landlord/lady within that time," Gullicksen told us.

It’s also important to keep paying your rent, Gullicksen warned, unless you can’t pay the full amount and have little hope of doing so any time soon.

"Nonpayment of rent is the easiest way for a landlord to evict a tenant," Gullicksen explained. "Don’t make life easier for the landlady who was perhaps trying to use the fact that your relatives have been staying with you for a month as grounds to evict you so she can convert your apartment into a pricey condominium."

There are, however, caveats to Gullicksen’s "always pay the rent" rule: if you don’t have the money or you don’t have all the money.

"Say you owe $1,000 but only have $750 when you get the eviction notice," Gullicksen explained. "In that case, you may want to not pay your landlord $750, in case he sits on it but still continues on with the eviction. Instead, you might want to put the money to finding another place or hiring an attorney."

A good lawyer can often delay an eviction — even if it’s over nonpayment or rent — and give you time to work out a deal. Many landlords, when faced with the prospect of a long legal fight, will come to the table. Gullicksen noted that the vast majority of eviction cases end in a settlement. "We encourage all tenants to fight evictions," he said. The Tenants Union can refer you to qualified tenant lawyers.

These days some tenants who live in buildings that have been foreclosed on are getting eviction notices. But in San Francisco, city officials are quick to point out, foreclosure is not a legal ground for eviction.

Another useful tip: if your landlord is cutting back on the services you get — whether it’s a loss of laundry facilities, parking, or storage space, or the owner has failed to do repairs or is preventing you from preventing you from "the quiet enjoyment of your apartment" — you may be able to get a rent reduction. With the passage of Proposition M in November 2008 tenants who have been subjected to harassment by their landlords are also eligible for rent reductions. That involves a petition to the San Francisco Rent Stabilization and Arbitration Board (www.sfgov.org/site/rentboard_index.asp).

Gullicksen also recommends that people who have lost their jobs check out the Eviction Defense Collaborative (www.evictiondefense.org).

"They are mostly limited to helping people who have temporary shortfalls," Gullicksen cautioned. But if you’ve lost your job and are about to start a new one and are a month short, they can help. (Sarah Phelan)

OUT OF WORK? HERE’S STEP ONE

How do you get your unemployment check?

"Just apply for it."

That’s the advice of California’s Employment Development Department spokesperson Patrick Joyce.

You may think you aren’t eligible because you may have been fired or were only working part-time, but it’s still worth a try. "Sometimes people are ineligible, but sometimes they’re not," Joyce said, explaining that a lot of factors come into play, including your work history and how much you were making during the year before you became unemployed.

"So, simply apply for it — if you don’t qualify we’ll tell you," he said. "And if you think you are eligible and we don’t, you can appeal to the Unemployment Insurance Appeals Board."

Don’t wait, either. "No one gets unemployment benefits insurance payments for the first week they are unemployed," Joyce explained, referring to the one-week waiting period the EDD imposes before qualified applicants can start collecting. "So you should apply immediately."

Folks can apply by filling out the unemployment insurance benefits form online or over the phone. But the phone number is frequently busy, so online is the best bet.

Don’t leave your home

On Oct. 4, 2008, Genevieve Hilpert came home to her apartment in the Outer Mission to find her gas shut off. The 35-year-old, who lives alone, hasn’t had gas service since then. Her landlord moved to the Philippines, the bank foreclosed on the property, and a real-estate broker assumed control.

Hilpert, an international student, was told by the broker to continue paying her rent, but she isn’t even sure who gets the check.

Hilpert is facing a problem all too common these days: she’s a tenant in a building that — through no fault of her own — is in the legal limbo of foreclosure. Hilpert is relatively lucky — she hasn’t been evicted. But necessary repairs, like the broken gas service, aren’t getting made.

The property manager, she told us, "hasn’t done anything. He hasn’t turned on the gas. [I] don’t know who is who."

Hilpert’s case demonstrates a less-publicized part of the nation’s housing crisis. In many instances, rent-paying, law-abiding tenants have come home to find padlocks on their doors and notes telling them to find other places.

The renters may have kept up with their bills — but the owners have not. And when a bank forecloses on a building, the tenants can be forced out. "The renters we’ve seen have been displaced," Sara Shortt, executive director of the Housing Rights Committee, told the Guardian. She mentioned that in many instances their utilities have been shut off, and renters have been left in a bind between brokers and banks. She said, "[Renters] are completely innocent victims of [the] financial crisis."

In San Francisco, it’s illegal for a bank or broker or anyone else to evict a tenant just because the ownership of a building changed hands. But many tenants don’t realize that.

In an effort to promote tenant-rights awareness, the Assessor-Recorder’s Office will be circuutf8g letters to inform tenants when a landlord has received a ‘Notice of Default’ — the precursor to a foreclosure. "According to San Francisco law," the letter says, "it is illegal for the new owner to ask you to leave without just cause or shut off your utilities." Since most of the renters who have been evicted by this latest ruse don’t speak English, the letter is being circulated in English, Spanish, and Chinese.

The letter advises tenants to contact housing organizations that can help, including the Housing Rights Committee of San Francisco, Comite De Vivienda San Pedro, and the Asian Law Caucus.

"Do not leave your home," said Assessor-Recorder Phil Ting, addressing tenants at a recent press conference.

The Assessor-Recorder’s Office estimates that 25 percent of all buildings that received a Notice of Default in San Francisco are occupied by tenants. And that’s a lot of tenants: according to the Housing Rights Committee, Notices of Default recorded with the city rose 94 percent between the 3rd quarter of 2006 and the 3rd quarter of 2008.

The Housing Rights Committee of San Francisco reported 75 cases in the past year involving tenants facing displacement after a foreclosure. In the month of September alone, there were 17 cases. The most common problems renters face include utility shut-offs, illegal eviction attempts, not knowing where to send rent, and illegal entry and harassment by brokers and landlords.

The law may seem confusing, and in some cities, a foreclosure may mean the tenants have to go. But that’s not the case in San Francisco. The city’s rent ordinance requires "just cause" for eviction — and a change of ownership, no matter the cause, is not in itself a just cause.

The San Francisco Rent Board’s literature makes that clear: "The Court of Appeal held in Gross v. Superior Court (1985) … that foreclosure, like any other sale, is not a just cause for eviction under the Rent Ordinance and provides no basis to force the tenant to leave."

As Shortt told us, "We’re worried about the folks out there that haven’t come to us…. We hope through this program people will be educated and know their rights, and not be displaced."

The stealth candidate

Ahsha Safai is hoping to be elected to the Board of Supervisors without answering questions about his padded political resume of short-lived patronage jobs, greatly exaggerated claims of his accomplishments, history as a predatory real estate speculator, connections to and coordination with downtown power brokers, shifting and contradictory policy positions, or the many other distortions this political neophyte is offering up to voters in District 11, a crucial swing district that could decide the balance of power in city government.

Safai has refused numerous requests for interviews with the Guardian over the last two months. We’ve even left messages with specific concerns about his record and positions. But our investigation reveals his close political ties to the downtown interest groups that have spent close to $100,000 on his behalf and shows him to be a shameless opportunist who is apparently willing to say anything to achieve power.

There’s much we don’t know about Ahsha Safai, but there’s enough we do know for a consistent yet troubling portrait to emerge.

Safai moved to San Francisco from Washington, DC with his lawyer wife in 2000, and immediately began to ingratiate himself into the mainstream Democratic Party power structure, starting as a legislative liaison with the corruption-plagued San Francisco Housing Authority and joining Gavin Newsom’s mayoral campaign in 2003.

Safai became a protégé of Newsom’s field director Alex Tourk, who was a top Newsom strategist for several years until he abruptly resigned after learning that Newsom had an affair with his wife. With support from Tourk (who didn’t respond to our calls about Safai) and Newsom, Safai held a string of city jobs over the next three years, moving from the Mayor’s Office of Community Development to the Mayor’s Office of Neighborhood Services to the Department of Public Works, all of which he touts on his Web ite, greatly exaggerating (and in some cases, outright misrepresenting) his accomplishments in each, according to those who worked with him. (Few sources who worked with Safai would speak on the record, fearing repercussions from Newsom).

THE CONNECT DISASTER


One project Safai doesn’t mention on his Web site is his work spearheading Community Connect, the most disastrous of Newsom’s SF Connect programs. "It’s the one Connect that the mayor will never talk about," said Quentin Mecke, who participated in the effort, on behalf of nonprofit groups, to create a community policing system. "The whole thing just devolved into chaos and there weren’t any more meetings."

In 2005, Safai and Tourk convened meetings in each of the city’s police precincts to take testimony on rising violence and the failure of the San Francisco Police Department to deal with it. Ultimately Newsom decided to reject a community-policing plan developed through the process by the African-American Police Community Relations Board. That set up the Board of Supervisors to successfully override a mayoral veto of police foot patrols.

"Ahsha’s approach was consistent with the Newsom administration, with folks that talk a good game but there’s no substance behind it," said Mecke, who ran for mayor last year, placing second.

Another realm in which Safai has claimed undeserved credit is on his efforts to save St. Luke’s Hospital from attempts by the California Pacific Medical Center (and CPMC’s parent company, Sutter Health) to close it or scale back its role as an acute care provider for low income San Franciscans.

"When I looked at his campaign material and he says he was a leader who saved St. Luke’s, I thought, ‘Am I missing something here?," Roma Guy, a 12-year member of the city’s Health Commission and leader in the effort to save St. Luke’s, told the Guardian. "Nobody thinks Ahsha has taken a leadership role on this. This is a significant exaggeration from where I sit."

Nato Green, who represents nurses at St. Luke’s within the California Nurses Association, went even further than Guy, saying he was worried about Safai’s late arrival to the issue (Safai wasn’t part of the group that protested, organized, and urged CPMC to agree to rebuild the hospital) and the fact that CPMC appointed Safai to its Community Outreach Task Force as the representative from Distrist 11.

"From our point of view, he is the CPMC’s AstroTurf program, simuutf8g community participation," Green told us. "It’s critical to us that we end up with a supervisor who is independent of CPMC and will go to the mat for what the community needs."

CNA has endorsed Avalos in the District 11 race.

"John was the only candidate in District 11 who came out and spoke at the hearings, attended the vigils, and walked the picket line during the strikes," Green said.


REAL ESTATE SPECULATION


Beyond his association with downtown power brokers and endorsement by Newsom, there are other indicators that Safai is hostile to progressive values. He said in a recent televised forum that he would work most closely with supervisors Carmen Chu, Sean Elsbernd, and Michela Alioto-Pier, the three most conservative members of the Board of Supervisors.

During an Oct. 14 Avalos fundraiser hosted by sustainable transportation advocates Dave Snyder, Tom Radulovich, and Leah Shahum, attendees expressed frustration at Safai’s tendency to pander to groups like the San Francisco Bicycle Coalition, taking whatever position he thinks they want to hear without considering their implications or consistency with his other stands.

"It was a no-brainer for the Bike Coalition to endorse John," Shahum, SFBC’s executive director, said at the event, noting Avalos’ long history of support for alternatives to the automobile.

Avalos, who had been hammered all week by mailers and robocalls from downtown groups supporting Safai, said he was frustrated by the barrage but that "we can fight the money with people.

"Ahsha has done everything he can to blur the lines about what he stands for," Avalos said. "Whoever he’s talking to, that’s who he’s going to be. But we need principled leadership in San Francisco."

One area where Safai doesn’t appear to be proud of his work is in real estate, opting to be identified on voting materials as a "nonprofit education advisor." One of his opponents, Julio Ramos, formally challenged the designation, writing to the Election Department that the label "would mislead voters and is not factually accurate, the term ‘businessman’ or ‘investor’ denotes the true livelihood of candidate Safai."

Safai responded by defending the title and writing, "My dates of employment at Mission Language Vocational School were from August 2007 through February 2008." So, because of his seven-month stint at this nonprofit, voters will see Safai as someone who works in education, even though his financial disclosure forms show that most of his six-figure income comes from Blankshore LLC, a Los Altos-based developer currently building a large condo project at 2189 Bayshore Blvd. that is worth more than $1 million. (That’s the top value bracket listed on the form, so we don’t know how many millions the project is actually worth or how much more than $100,000 Safai earned this year).

But we do know from city records that Safai has personally bought at least three properties during his short stint in San Francisco, including one at 78 Latona Street that he flipped for a huge profit after buying it from a woman facing foreclosure, who then sued Safai for fraud.

The woman, Mary McDowell, alleged in court documents that real estate broker Harold Smith, "unsolicited, came to plaintiff’s residence and offered assistance to her because her homes were in foreclosure … [and said] she would receive sufficient money after sales commissions to reinstate the loans on the four other properties."

The legal complaint said Smith then modified those terms to pay McDowell less than promised and arranged to sell the home to Safai and his brother, Reza. "Plaintiff is informed and believes and thereon alleges that defendants did not promptly list her residence on the multiple listing service to avoid larger offers on the home and conspired with the other defendants to purchase the home at a far less than market price," reads the complaint.

The case was originally set for jury trial, indicating it had some merit. But after numerous pleadings and procedural actions that resulted in the plaintiff’s attorney being sanctioned for failing to meet certain court deadlines and demands, the case was dismissed.
But whatever the merit to the case, records on file with the county assessor and recorder show that Safai and his brother flipped the property for a tidy profit. They paid $365,500 for the place in December 2003 — and sold it two year later, in December 2005, for $800,000.
Labor activist Robert Haaland told us that Safai can’t be trusted to support rent control or the rights of workers or tenants: "At the end of the day, he’s a real estate speculator."

District 1

ERIC MAR


The incumbent District 1 supervisor, Jake McGoldrick, likes to joke that he holds his seat only because Eric Mar’s house burned down eight years ago. Back then Mar, who has had a stellar career on the school board, decided to wait before seeking higher office.

But now McGoldrick — overall a good supervisor who was wrong on a few key votes — is termed out, and progressive San Francisco is pretty much unanimous in supporting Mar as his successor.

Mar, a soft-spoken San Francisco State University teacher, was a strong critic of former school superintendent Arlene Ackerman and a leader in the battle to get the somewhat dictatorial and autocratic administrator out of the district. He’s been a key part of the progressive majority that’s made substantial progress in improving the San Francisco public schools.

He’s a perfect candidate for District 1. He has strong ties to the district and its heavily Asian population. He’s a sensible progressive with solid stands on the key issues and a proven ability to get things done. He supports the affordable housing measure, Proposition B; the Clean Energy Act, Proposition H; and the major new revenue measures. He’s sensitive to tenant issues, understands the need for a profound new approach to affordable housing, and wants to solve the city’s structural budget problems with new revenue, not just cuts.

His chief opponent, Sue Lee, who works for the Chamber of Commerce, doesn’t support Prop. H and won’t even commit to supporting district elections. She ducked a lot of our questions and was either intentionally vague or really has no idea what she would do as a supervisor. She’s no choice for the district, and we found no other credible candidates worthy of our endorsement. Vote for Eric Mar.

The danger in this district is Joe Alioto. He’s smooth, he’s slick, he’s well funded — and he would be a disaster for San Francisco. Make no mistake about it, Alioto is the candidate of downtown — and thanks to his famous name and wads of big-business cash, he’s a serious contender.

Two progressive candidates have a chance at winning this seat and keeping Alioto off the board. David Chiu is a member of the Small Business Commission (SBC) and the Democratic County Central Committee (DCCC) and is a former civil rights lawyer who now manages a company that sells campaign software. Denise McCarthy ran the Telegraph Hill Neighborhood Center for 25 years and spent 7 years on the Port Commission.

Tony Gantner, a retired lawyer, is also in the race, although he is running well behind the others in the polls.

We have concerns about all the candidates. Chiu has a solid progressive record as a commissioner and committee member: He was one of only two SBC members who supported the living-wage ordinance and Sup. Tom Ammiano’s city health care plan. He backed Sup. Aaron Peskin, his political mentor, for chair of the DCCC. He backs Prop. H, supports the two revenue measures and the affordable-housing fund, and wants to give local small businesses a leg up in winning city contracts. He has some creative ideas about housing, including a community stabilization fee on new development.

He’s also a partner in a company that received $143,000 last year from PG&E and that has worked with Republicans and some nasty business interests.

Chiu says he doesn’t get to call all the shots at Grassroots Enterprises, which he cofounded. He describes the firm as a software-licensing operation, which isn’t exactly true — the company’s own Web site brags about its ability to offer broad-based political consulting and communication services.

But Chiu vowed to resign from the company if elected, and given his strong record on progressive issues, we’re willing to take a chance on him.

McCarthy has a long history in the neighborhood, and we like her community perspective. She supports Prop. H and the affordable-housing measure. She’s a little weak on key issues like the city budget — she told us she "hadn’t been fully briefed," although the budget is a public document and the debate over closing a massive structural deficit ought to be a central part of any supervisorial campaign. And while she said there "have to be some new taxes," she was very vague on where new revenue would come from and what specifically she would be willing to cut. She supported Gavin Newsom for mayor in 2003 and told us she doesn’t think that was a bad decision. It was. But she has by far the strongest community ties of any candidate in District 3. She’s accessible (even listing her home phone number in her campaign material), and after her years on the Port Commission, she understands land-use issues.

Gantner has been a supporter of the Clean Energy Act from the start and showed up for the early organizing meetings. He has the support of the Sierra Club and San Francisco Tomorrow and talks a lot about neighborhood beatification. But we’re a little nervous about his law-and-order positions, particularly his desire to crack down on fairs and festivals and his strong insistence that club promoters are responsible for all the problems on the streets.

But in the end, Chiu, McCarthy, and Gantner are all acceptable candidates, and Joe Alioto is not. Fill your slate with these three.

District 4

DAVE FERGUSON


What a mess.

We acknowledge that this is one of the more conservative districts in the city. But the incumbent, Carmen Chu, and her main opponent, Ron Dudum, are terrible disappointments.

It’s possible to be a principled conservative in San Francisco and still win progressive respect. We often disagreed over the years with Quentin Kopp, the former supervisor, state senator, and judge, but we never doubted his independence, sincerity, or political skills. Sean Elsbernd, who represents District 7, is wrong on most of the key issues, but he presents intelligent arguments, is willing to listen, and isn’t simply a blind loyalist of the mayor.

Chu has none of those redeeming qualities. She ducks questions, waffles on issues, and shows that she’s willing to do whatever the powerful interests want. When PG&E needed a front person to carry the torch against the Clean Energy Act, Chu was all too willing: she gave the corrupt utility permission to use her name and face on campaign flyers, signed on to a statement written by PG&E’s political flak, and permanently disgraced herself. She says that most of the problems in the city budget should be addressed with cuts, particularly cuts in public health and public works, but she was unable to offer any specifics. She refused to support the measure increasing the transfer tax on property sales of more than $5 million, saying that she didn’t want to create "a disincentive to those sales taking place." We asked her if she had ever disagreed with Newsom, who appointed her, and she could point to only two examples: she opposed his efforts to limit cigarette sales in pharmacies, and she opposed Saturday road closures in Golden Gate Park. In other words, the only times she doesn’t march in lockstep with the mayor is when Newsom actually does something somewhat progressive. We can’t possibly endorse her.

Dudum, who ran a small business and tried for this office two years ago, continues to baffle us. He won’t take a position on anything. Actually, that’s not true — he’s opposed to the Clean Energy Act. Other than that, it’s impossible to figure out where he stands on anything or what he would do to address any of the city’s problems. (An example: When we asked him what to do about the illegal second units that have proliferated in the district, he said he’d solve the problem in two years. How? He couldn’t say.) We like Dudum’s small-business sentiments and his independence, but until he’s willing to take some stands and offer some solutions, we can’t support him.

Which leaves Dave Ferguson.

Ferguson is a public school teacher with little political experience. He’s a landlord, and not terribly good on tenant issues (he said he supported rent control when he was a renter, but now that he owns a four-unit building, he’s changed his mind). But he supports Prop. H, supports Prop. B, supports the revenue measures, and has a neighborhood sensibility. Ferguson is a long shot, but he’s the only candidate who made anything approaching a case for our endorsement.

District 5

ROSS MIRKARIMI


Mirkarimi won this seat four years ago after a heated race in a crowded field, and he’s quickly emerged as one of the city’s most promising progressive leaders. He understands that a district supervisor needs to take on tough citywide issues (he’s the lead author of the Clean Energy Act and won a surprisingly tough battle to ban plastic bags in big supermarkets) as well as dealing with neighborhood concerns. Mirkarimi helped soften a terrible plan for developing the old UC Extension site and fought hard to save John Swett School from closure.

But the area in which he’s most distinguished himself is preventing violent crime — something progressives have traditionally had trouble with. Four years ago, District 5 was plagued with terrible violence: murders took place with impunity, the police seemed unable to respond, and the African American community was both furious and terrified. Mirkarimi took the problem on with energy and creativity, demanding (and winning, despite mayoral vetoes) police foot patrols and community policing. Thanks to his leadership, violent crime is down significantly in the district — and the left in San Francisco has started to develop a progressive agenda for the crime problem.

He has no serious opposition, and richly deserves reelection.

District 7

SEAN ELSBERND


We rarely see eye to eye with the District 7 incumbent. He’s on the wrong side of most of the key votes on the board. He’s opposing the affordable housing measure, Prop. B. He’s opposed to the Clean Energy Act, Prop. H. It’s annoying to see someone who presents himself as a neighborhood supervisor siding with PG&E and downtown over and over again.

But Elsbernd is smart and consistent. He’s a fiscal conservative with enough integrity that he isn’t always a call-up vote for the mayor. He’s accessible to his constituents and willing to engage with people who disagree with him. The progressives on the board don’t like the way he votes — but they respect his intelligence and credibility.

Unlike many of the candidates this year, Elsbernd seems to understand the basic structural problem with the city budget, and he realizes that the deficit can’t be reduced just with spending cuts. He’s never going to be a progressive vote, but this conservative district could do worse.

District 9

The race to succeed Tom Ammiano, who served this district with distinction and is now headed for the State Legislature, is a case study in the advantages of district elections and ranked-choice voting. Three strong progressive candidates are running, and the Mission–Bernal Heights area would be well served by any of them. So far, the candidates have behaved well, mostly talking about their own strengths and not trashing their opponents.

The choice was tough for us — we like David Campos, Eric Quezada, and Mark Sanchez, and we’d be pleased to see any of them in City Hall. It’s the kind of problem we wish other districts faced: District 9 will almost certainly wind up with one of these three stellar candidates. All three are Latinos with a strong commitment to immigrant rights. All three have strong ties to the neighborhoods. Two are openly gay, and one is a parent. All three have endorsements from strong progressive political leaders and groups. All three have significant political and policy experience and have proven themselves accessible and accountable.

And since it’s almost inconceivable that any of the three will collect more than half of the first-place votes, the second-place and third-place tallies will be critical.

Campos, a member of the Police Commission and former school district general counsel, arrived in the United States as an undocumented immigrant at 14. He made it to Stanford University and Harvard Law School and has worked as a deputy city attorney (who helped the city sue PG&E) and as a school district lawyer. He’s been a progressive on the Police Commission, pushing for better citizen oversight and professional police practices. To his credit, he’s stood up to (and often infuriated) the Police Officers’ Association, which is often a foe of reform.

Campos doesn’t have extensive background in land-use issues, but he has good instincts. He told us he’s convinced that developers can be forced to provide as much as 50 percent affordable housing, and he thinks the Eastern Neighborhoods Plan lacks adequate low-cost units. He supports the revenue measures on the ballot and wants to see big business paying a fair share of the tax burden. He argues persuasively that crime has to become a progressive issue, and focuses on root causes rather than punitive programs. Campos has shown political courage in key votes — he supported Theresa Sparks for Police Commission president, a move that caused Louise Renne, the other contender, to storm out of the room in a fit of cursing. He backed Aaron Peskin for Democratic Party chair despite immense pressure to go with his personal friend Scott Weiner. Ammiano argues that Campos has the right qualities to serve on the board — particularly the ability to get six votes for legislation — and we agree.

Eric Quezada has spent his entire adult life fighting gentrification and displacement in the Mission. He’s worked at nonprofit affordable-housing providers, currently runs a homeless program, and was a cofounder of the Mission Anti-Displacement Coalition. Although he’s never held public office, he has far more experience with the pivotal issues of housing and land use than the other two progressive candidates.

Quezada has the support of Sup. Chris Daly (although he doesn’t have Daly’s temper; he’s a soft-spoken person more prone to civil discussion than fiery rhetoric). If elected, he would carry on Daly’s tradition of using his office not just for legislation but also as an organizing center for progressive movements. He’s not as experienced in budget issues and was a little vague about how to solve the city’s structural deficit, but he would also make an excellent supervisor.

Mark Sanchez, the only Green Party member of the three, is a grade-school teacher who has done a tremendous job as president of the San Francisco school board. He’s helped turn that panel from a fractious and often paralyzed political mess into a strong, functioning operation that just hired a top-notch new superintendent. He vows to continue as an education advocate on the Board of Supervisors.

He told us he thinks he can be effective by building coalitions; he already has a good working relationship with Newsom. He’s managed a $500 million budget and has good ideas on both the revenue and the spending side — he thinks too much money goes to programs like golf courses, the symphony, and the opera, whose clients can afford to cover more of the cost themselves. He wants a downtown congestion fee and would turn Market Street into a pedestrian mall. Like Campos, he would need some education on land-use issues (and we’re distressed that he supports Newsom’s Community Justice Center), but he has all the right political instincts. He has the strong support of Sup. Ross Mirkarimi. We would be pleased to see him on the Board of Supervisors.

We’ve ranked our choices in the order we think best reflects the needs of the district and the city. But we also recognize that the progressive community is split here (SEIU Local 1021 endorsed all three, with no ranking), and we have nothing bad to say about any of these three contenders. The important thing is that one of them win; vote for Campos, Quezada, and Sanchez — in that order, or in whatever order makes sense for you. Just vote for all three.

District 11

This is one of those swing districts where either a progressive or a moderate could win. The incumbent, Gerardo Sandoval, who had good moments and not-so-good moments but was generally in the progressive camp, is termed out and running for judge.

The strongest and best candidate to succeed him is John Avalos. There are two other credible contenders, Randy Knox and Julio Ramos — and one serious disaster, Ahsha Safai.

Avalos has a long history of public-interest work. He’s worked for Coleman Advocates for Children and Youth, for the Justice for Janitors campaign, and as an aide to Sup. Chris Daly. Since Daly has served on the Budget Committee, and at one point chaired it, Avalos has far more familiarity with the city budget than any of the other candidates. He understands that the city needs major structural reforms in how revenue is collected, and he’s full of new revenue ideas. Among other things, he suggests that the city work with San Mateo County to create a regional park district that could get state funds (and could turn McLaren Park into a destination spot).

He has a good perspective on crime (he supports community policing along with more police accountability) and wants to put resources into outreach for kids who are at risk for gang activity. He was the staff person who wrote Daly’s 2006 violence prevention plan. He wants to see more affordable housing and fewer luxury condos in the eastern neighborhoods and supports a congestion fee for downtown. With his experience both at City Hall and in community-based organizations, Avalos is the clear choice for this seat.

Randy Knox, a criminal defense lawyer and former member of the Board of Appeals, describes himself as "the other progressive candidate." He supports Prop. H and the affordable-housing fund. He links the crime problem to the fact that the police don’t have strong ties to the community, and wants to look for financial incentives to encourage cops to live in the city. He wants to roll back parking meter rates and reduce the cost of parking tickets in the neighborhoods, which is a populist stand — but that money goes to Muni, and he’s not sure how to replace it. He does support a downtown congestion fee.

Knox wasn’t exactly an anti-developer stalwart on the Board of Appeals, but we’ll endorse him in the second slot.

Julio Ramos has been one of the better members of a terrible community college board. He’s occasionally spoken up against corruption and has been mostly allied with the board’s progressive minority. He wants to build teacher and student housing on the reservoir adjacent to City College. He suggests that the city create mortgage assistance programs and help people who are facing foreclosure. He suggests raising the hotel tax to bring in more money. He supports public power and worked at the California Public Utilities Commission’s Division of Ratepayer Advocates, where he tangled with PG&E.

We’re backing three candidates in this district in part because it’s critical that Safai, the candidate of Mayor Newsom, downtown, and the landlords, doesn’t get elected. Safai (who refused to meet with our editorial board) is cynically using JROTC as a wedge against the progressives, even though the Board of Supervisors does not have, and will never have, a role in deciding the future of that program. He needs to be defeated, and the best way to do that is to vote for Avalos, Knox, and Ramos.

Two of the stalwart progressive leaders on the San Francisco School Board — Mark Sanchez and Eric Mar — are stepping down to run for supervisor. That’s a huge loss, since Mar and Sanchez were instrumental in getting rid of the autocratic Arlene Ackerman, replacing her with a strong new leader and ending years of acrimony on the board. The schools are improving dramatically — this year, for the first time in ages, enrollment in kindergarten actually went up. It’s important that the progressive policies Mar and Sanchez promoted continue.

Sandra Fewer is almost everyone’s first choice for the board. A parent who sent three kids to the San Francisco public schools, she’s done an almost unbelievable amount of volunteer work, serving as a PTA president for 12 terms. She currently works as education policy director at Coleman Advocates for Children and Youth. She knows the district, she knows the community, she’s full of energy and ideas, and she has the support of seven members of the Board of Supervisors and five of the seven current school board members.

Fewer supports the new superintendent and agrees that the public schools are getting better, but she’s not afraid to point out the problems and failures: She notes that other districts with less money are doing better. She wants to make the enrollment process more accessible to working parents and told us that race ought to be used as a factor in enrollment if that will help desegregate the schools and address the achievement gap. She’s against JROTC in the schools.

We’re a little concerned that Fewer talks about using district real estate as a revenue source — selling public property is always a bad idea. But she’s a great candidate and we’re happy to endorse her.

Norman Yee, the only incumbent we’re endorsing, has been something of a mediator and a calming influence on an often-contentious board. He helped push for the 2006 facilities bond and the parcel tax to improve teacher pay. He’s helped raise $1 million from foundations for prekindergarten programs. He suggests that the district take the radical (and probably necessary) step of suing the state to demand adequate funding for education. Although he was under considerable pressure to support JROTC, he stood with the progressives to end the military program. He deserves another term.

Barbara "Bobbi" Lopez got into the race late and has been playing catch-up. She’s missed some key endorsements and has problems with accessibility. But she impressed us with her energy and her work with low-income parents. A former legal support worker at La Raza Centro Legal, she’s now an organizer at the Tenderloin Housing Clinic, working with immigrant parents. She’s fought to get subsidized Muni fares for SFUSD students. Her focus is on parent involvement — and while everyone talks about bringing parents, particularly low-income and immigrant parents, more directly into the education process, Lopez has direct experience in the area.

Kimberly Wicoff has a Stanford MBA, and you can tell — she talks in a sort of business-speak with lots of reference to "outcomes." She has no kids. But she’s currently working with a nonprofit that helps low-income families in Visitacion Valley and Hunters Point, and we liked her clearheaded approach to the achievement gap. Wicoff is a fan of what she calls community schools; she thinks a "great school in every neighborhood" can go a long way to solving the lingering issues around the enrollment process. That’s a bit of an ambitious goal, and we’re concerned about any move toward neighborhood schools that leads to resegregation. But Wicoff, who has the support of both Mark Sanchez and Mayor Newsom, brings a fresh problem-solving approach that we found appealing. And unlike Newsom, she’s against JROTC.

Jill Wynns, who has been on the board since 1992, has had a distinguished career, and we will never forget her leadership in the battle against privatizing public schools. But she was a supporter of former superintendent Ackerman even when Ackerman was trampling on open-government laws and intimidating students, parents, and staff critics, and she supports JROTC. It’s time for some new blood.

Rachel Norton, a parent and an advocate for special-education kids, has run an appealing campaign, but her support for the save-JROTC ballot measure disqualified her for our endorsement.

As a footnote: H. Brown, a blogger who can be a bit politically unhinged, has no business on the school board and we’re not really sure why he’s running. But he offered an interesting idea that has some merit: he suggests that the city offer free Muni passes and free parking to anyone who will volunteer to mentor an at-risk SFUSD student. Why not?

Community College Board

There are four seats up for the seven-member panel that oversees the San Francisco Community College District, and we could only find three who merit endorsement. That’s a sad statement: City College is a local treasure, and it’s been badly run for years. The last chancellor, Phil Day, left under a cloud of corruption; under his administration, money was diverted from public coffers into a political campaign. The current board took bond money that the voters had earmarked for a performing arts center and shifted it to a gym — then found out that there wasn’t enough money in the operating budget to maintain the lavish facility. It’s a mess out there, and it needs to be cleaned up.

Fortunately, there are three strong candidates, and if they all win, the reformers will have a majority on the board.

Milton Marks is the only incumbent we’re supporting. He’s been one of the few board members willing to criticize the administration. He supports a sunshine policy for the district and believes the board needs to hold the chancellor accountable (that ought to be a basic principle of district governance, but at City College, it isn’t). He wants to push closer relations with the school board. He actually pays attention to the college budget and tries to make sure the money is spent the right way. He is pushing to reform the budget process to allow more openness and accountability.

Chris Jackson, a policy analyst at the San Francisco Labor Council, is full of energy and ideas. He wants to create an outreach center for City College at the public high schools. He also understands that the college district has done a terrible job working with neighborhoods and is calling for a comprehensive planning process. He understands the problems with the gym and the way the board shuffles money around, and he is committed to a more transparent budget process.

Jackson is also pushing to better use City College for workforce development, particularly in the biotech field, where a lot of the city’s new jobs will be created.

Jackson was president of the Associated Students at San Francisco State University, has been a member of the Youth Commission, and worked with Young Workers United on the city’s minimum-wage law. His experience, energy, and ideas make him an ideal candidate.

Bruce Wolfe attended City College after a workplace injury and served on the Associate Students Council. He knows both the good (City College has one of the best disability service programs in the state) and the bad (the school keeps issuing bonds to build facilities but doesn’t have the staff to keep them running). As a former member of the San Francisco Sunshine Ordinance Task Force, Wolfe is a strong advocate for open government, something desperately needed at the college district. He told us he thinks the college should agree to abide by the San Francisco Planning Code and is calling for a permanent inspector general to monitor administration practices and spending. He wants City College to start building housing for students. He has direct experience with the district and great ideas for improving it, and we’re happy to endorse him.

Incumbents Rodel Rodis and Natalie Berg are running for reelection; both have been a key part of the problem at City College, and we can’t endorse either of them. Steve Ngo, a civil rights lawyer, has the support of the Democratic Party, but we weren’t impressed by his candidacy. And he told us he opposes the Clean Energy Act.

Vote for Marks, Jackson, and Wolfe.

BART Board of Directors

With rising gasoline prices, congested roadways, and global warming, it’s now more important than ever to have an engaged and knowledgeable BART board that is willing to reform a system that effectively has San Francisco users subsidizing everyone else. That means developing a fare structure in which short trips within San Francisco or the East Bay urban centers are cheaper and longer trips are a bit more expensive. BART should also do away with free parking, which favors suburban drivers (who tend to be wealthier) over urban cyclists and pedestrians. San Francisco’s aging stations should then get the accessibility and amenity improvements they need—and at some point the board can even fund the late-night service that is long overdue. There are two candidates most capable of meeting these challenges:

District 7

LYNETTE SWEET


This district straddles San Francisco and the East Bay, and it’s crucial that San Francisco—which controls just three of the nine seats—retain its representative here. We would like to see Lynette Sweet more forcefully represent the interests of riders from San Francisco and support needed reforms such as civilian oversight of BART police. But she has a strong history of public service in San Francisco (having served on San Francisco’s taxi and redevelopment commissions before joining the BART board in 2003), and we’ll endorse her.

District 9

TOM RADULOVICH


Tom Radulovich is someone we’d love to clone and have run for every seat on the BART board, and perhaps every other transportation agency in the Bay Area. He’s smart and progressive, and he works hard to understand the complex problems facing our regional transportation system and then to develop and advocate for creative solutions. As executive director of the nonprofit Livable City, Radulovich is a leader of San Francisco’s alternative transportation brain trust, widely respected for walking the walk (and biking the bike—he doesn’t own a car) and setting an example for how to live and grow in the sustainable way this city and country needs.

McCain is right that the country is facing a historic economic crisis, but canceling his debate with Obama on Friday?
He says it’s time for both parties to come together to solve the economic crisis, but it sounds like he has cold feet.

Don’t know about you, but I was figuring that the debate would be a chance for the candidates to tell us more about their thoughts on the issue, at a time when the American public desperately needs insights and guidance.

Obama is reported to still want to hold the debate, and a statement is expected from his campaign shortly. Meanwhile, here’s what Obama is saying about the financial meltdown:

“The era of greed and irresponsibility on Wall Street and in Washington has created a financial crisis as profound as any we have faced since the Great Depression.

Congress and the President are debating a bailout of our financial institutions with a price tag of $700 billion or more in taxpayer dollars. We cannot underestimate our responsibility in taking such an enormous step.

Whatever shape our recovery plan takes, it must be guided by core principles of fairness, balance, and responsibility to one another.

Please sign on to show your support for an economic recovery plan based on the following:

• No Golden Parachutes — Taxpayer dollars should not be used to reward the irresponsible Wall Street executives who helmed this disaster.

• Main Street, Not Just Wall Street — Any bailout plan must include a payback strategy for taxpayers who are footing the bill and aid to innocent homeowners who are facing foreclosure.

The Mayor’s Office of Housing has come under attack for failing to construct enough inclusionary affordable housing units and for not doing enough financially to help folks facing foreclosures.

The charges come as D 11 Sup. Geraldo Sandoval and D 6 Sup. Chris Daly seek to amend off-site inclusionary affordable housing requirements.

The amendments would allow that twenty-five percent off off-site units may be built outside the currently required one-mile radius from a developer’s market rate project.

They would also provide that off-site units cannot be located in industrially-zoned areas, or within one-quarter of a mile of developments containing 200 or more publicly-owned and operated affordable housing developments.

“The fact that not one affordable housing development has been promoted by the Mayor’s Office of Housing or the non-profit sector, in District 11 tells me that something is wrong,” said Sandoval, whose district includes the Outer Mission and the Excelsior and is home to the highest foreclosure rate in the City.

Sandoval noted that when he proposed an emergency fund last year to fight foreclosures, MOH opposed the idea.

“That program went nowhere,” Sandoval observed.
“And every time I have tried to get a non-profit housing developer into District 11, they do not and have not got any help from the Mayor’s Office of Housing,” he added.

Noting that the proposed amendment also amounts to a small program (Twenty-five percent of a 25 percent mandate is a small subset,) Sandoval said, “I can’t understand why the Mayor’s Office of Housing is so eager to oppose it. This is about fairness.”

MOH’s Doug Shoemaker countered that the amendments are “a solution in search of a problem.”

Shoemaker reminded the Board why the supervisors updated inclusionary affordable housing legislation a few years ago to make sure that offsite units were built within a one- mile of developers’ market rate sites.

“It was because affordable units were being built where no one wanted it, under freeways, the far end of city, and remote from retail, services and transportation,” Shoemaker recalled.

“Our main concern,” he said, “is that development will end up being built under the cloverleaf of 101 and 280. Developers seek lowest land prices. They are rational. They seek cost savings.”

Sup. Maxwell sided with Shoemaker, noting that the legislation that Daly and Sandoval seek to amend was put together less than 18 months ago.

“The poorest people need to be where the infrastructure and schools are,” Maxwell said.

Sup. Tom Ammiano also opposed the amendments.
“It takes away a lot of the choices we have,” he said

But Sup. Bevan Dufty supported Daly and Sandoval’s efforts, noting that he’s been seeking more affordable housing in his district in the last years, with almost no success.

“To me this is not a mandate that 25 percent [of these affordable units] has to be a mile away.” Dufty said.

Claiming that if developers proposed inaccessible offsite units, the Board would not support it, Dufty added, “But a little bit of flexibility isn’t a bad thing.”

“This is such a modest proposal. I can’t believe we’re denying it,” Sandoval lashed out.

Sandoval observed that thanks to the MOH opposition to the Board’s proposed $2 million revolving foreclosure fund, all the City has, on the foreclosure front, is a task force and a comprehensive report.
“That’s not the same thing as helping people, “ he said. “If this passes, we might be able to.”

MOH contends it’s been busy trying to put infrastructure in place, so it can help people access the federal foreclosure package that President Bush just signed into law.

In the end, the Board kicked Sandoval and Daly’s amendments back to committee.

“Perhaps some massaging is in order,” Daly acknowledged.

Lennar asks feds for help–Republican senator blocks bill

Are we worried, yet? With San Francisco having climbed deeper into bed with Lennar thanks to Prop. G’s passage, the bad news coming from Wall Street and beyond can’t exactly be music to Mayor Gavin Newsom’s ears.

As Lennar reported bigger-than-expected quarterly losses today, Lennar’s Chief Executive Officer Stuart Miller expressed hope that the federal government would soon belly up and help bail out the beleagured housing industry.

Miller cited increased foreclosures, higher unemployment rates and diminished consumer confidence as reasons why the Florida-based mega developer experienced a 61 percent loss in revenues this quarter.

“With the U.S. housing inventory growing in excess of absorption and limited credit available, the prospect of further deterioration in the homebuilding industry will likely become reality absent Federal government action,” said Miller, who is apparently hedging his political bets by making the maximum campaign contribution to both presidential candidates.

“To that end, we are hopeful that the Federal government will acknowledge the need for further reform and will institute programs designed to stabilize and facilitate the recovery of the housing market.”

But a government plan to address the nationwide foreclosure crisis hit a roadblock in the Senate yesterday in the shape of a Republican from Nevada, Sen. John Ensign.

Sen. John Ensign (Nevada) wants $7 billion for renewable energy tax credits before he’ll support foreclosure bill.

This isn’t the first time that Ensign has played the role of lone obstructionist.

In September 2007, the Senate discovered that Ensign was using the “secret hold” to obstruct a bill that requires senators to file fund-raising reports electronically, rather than bury the identity of their benefactors in paper filings.

And for a short period in March 2006, Ensign blocked the nomination of Vice Admiral Thad Allen (who replaced FEMA director Mike Brown in the aftermath of Hurricane Katrina) to become the next Commandant of the U.S. Coast Guard.

But now Ensign, who reportedly has been tasked with assembling a staff to win back the U.S. Senate for Republicans in November 2008, is blocking a foreclosure rescue plan that has broad bipartisan support until he gets a vote on his amendment to provide almost $7 billion in renewable energy tax credits.

As a result, passage of the housing bill to create a multi-billion fund to aid thousands of homeowners refinance costly mortgages into more affordable government-backed loans, will likely be delayed until after July 4.

“In an election year, very few things are actually going to make it into law,” Ensign told reporters, “So if you actually want to get something done, you need to be on that train that is basically going to be leaving the station.”

Here in San Francisco, Lennar Corp. has assured elected officials that there is no relationship between LandSource, a land and development company that filed for Chapter 11 bankruptcy on Sunday, June 8, and Lennar’s Bayview Hunter’s Point project.

In a June 9 letter to San Francisco Mayor Gavin Newsom, Lennar Corporation’s Chief Investment Officer Emile Haddad wrote, “We anticipate that there may be some effort to link LandSource to other Lennar ventures, including Hunters Point Shipyard. Let me be clear: There is no relationship between the two entities. Hunters Point has its own capital structure and financial partners.”

Haddad does not however explicitly mention that LandSource, which owns properties in California, Arizona, Florida, Texas and New Jersey, does have a relationship with Lennar Mare Island, which also filed bankruptcy June 8, leaving city officials in the already bankrupt Vallejo doubly stressed.

And nowhere does Haddad guarantee San Francisco a smooth, obstacle-free redevelopment of Bayview Hunters Point, which apparently is already facing a potentially fatal $25 million funding gap, according to City officials.

“Lennar is committed to continuing to work closely with our community partners and the City and County of San Francisco to overcome any obstacles and to work toward a successful venture,” Haddad writes. “You have my personal reassurance that we will keep you fully informed of any and all significant developments that may impact the project.”

“Likewise, we will continue to utilize the development’s partnership experience and qualifications to leverage all state and federal funding sources to enhance the project and ensure its timely completion.”

As for Lennar’s CEO Stuart Miller, he told investors that “notwithstanding the bleak operating environment, Lennar made significant progress during our second quarter.”

This progress included reducing unsold completed inventory. “We now have on average less than one completed unsold home per community.”
Lennar also reduced selling, general and administrative expenses by 60 percent.

Sounds like a potential Triple Uhoh.

“We recognize that the remainder of 2008 will likely see further deterioration in overall market conditions; however, we are confident that we will remain well positioned with a strong balance sheet and properly scaled operations to navigate the current market downturn as a leaner and more efficient homebuilder.”

Meanwhile, following a posting of a video showing some community members less than positive take on Lennar, someone replied with a video about Lennar’s homebuilding operations in Texas.

Seems like some folks in the Bayview aren’t the only ones, er, frustrated with Lennar.

Hellarity burns

"The angels in the summertime are ashes in the fall. As Eden fell so heaven shall. I will burn them all."

The sign, written in gothic letters on weatherworn plywood with faded red flames, is nailed to the side gate of a two-story duplex off Martin Luther King Jr. Way in north Oakland. Today, the old sign’s words carry a chilling new meaning, greeting visitors to a house whose insides were scorched by an unidentified arsonist.

The charred house has been a cauldron of contention for more than 10 years. It has been the product of two anticapitalist housing experiments, one started by an environmentalist landlord who sought to create an ecotopia, and the other by a group of anarchists who intended to make it their home. In the process, it became a hub for traveling activists and aspiring hobos, and a headquarters for antiestablishment endeavors such as Berkeley Liberation Radio.

"People would hear about it through the grapevine, hop off a freight train, and show up on our doorstep with a backpack, a banjo, and a Woody Guthrie song," says Steve DiCaprio, a tenant who moved into the house in 2001 with his wife after living in a van out front. "We had an open-door policy. Anyone could come in, no questions asked. They just had to abide by certain rules: no hard drugs, no racism, no homophobia, and no violence. We wanted to emphasize equality — it was a reaction to the closed, materialistic, competitive, dog-eat-dog society we live in."

The house originally was part of the green property owner’s attempt to create a network of sustainable, affordable housing. When his project floundered, the residence was slowly taken over by his tenants, a group of people who one-upped his radicalism. Both sides claimed to be avowed anticapitalists, but their strategies were at odds; his was to produce an alternative to the local housing market by creating a nonprofit that would help tenants own their homes as a collective. Theirs was to make space for themselves in a rent-based housing market by seizing property from investors and absentee landlords.

The owner eventually went bankrupt — drowned in the early stages of the current defutf8g housing market — and the property fell into the hands of a small-time real estate investor, despite the tenants’ attempts to buy it themselves. The tenants refused to leave, transforming themselves into squatters, and fought it out with the buyer in court for three years. As the court case bogged down, housing values plummeted, making the landlord’s investment lose value by the day.

On Feb. 28, when one of many hearings was set to take place, the squatters showed up in court but the landlord hadn’t filed the paperwork needed to move the conflict closer to a resolution. The following night, in the early hours of March 1, someone lit three fires in the empty upper apartment, setting the house ablaze as people slept inside.

WELCOME TO HELLARITY


For years the house has been known as "Hellarity," although its original owner never called it that. In fact, he refuses to. To recognize that name would be to legitimize the people who adorned it with the title — a group he sees as thieves, squatters who disrupted a legitimate project he thought would have a small but tangible impact on a profit-driven housing market.

Born on the Sunrise Free School in northeastern Washington State, Sennet Williams — known by most as "Sand" — spent his early years bouncing between Spokane and "environmental and pacifist intentional communities" in the area. A year after moving to Berkeley in 1990, he graduated from UC Berkeley’s Hass School of Business. With a degree in urban land economics, he wanted to do his part to turn the tide of environmental degradation by developing "nonprofit car-free housing" in Berkeley.

Williams didn’t see attending business school or investing in property as contradictions of his ideals. For Williams, they were strategic moves. He thought that anticapitalist projects lacked an important element — money — and wanted to be a benefactor for alternative forms of housing.

One week after graduating, his dreamy aspirations came to a crashing halt when an SUV plowed into his compact car while he was on a ski trip at Lake Tahoe, badly injuring him and causing brain damage. His goals would have been quickly destroyed, but Williams sued the driver and convinced the court that the accident interfered with his budding career, winning a settlement in 1993 that he says was "almost a million dollars."

While his money was tucked away in mutual funds and he was living briefly at a student co-op in Ann Arbor, Mich., in 1994, Williams solidified his ideas into an ambitious project called the "Green Plan" with some of his housemates. The plan was an elaborate scheme to "end homelessness" by creating "an urban nonprofit dedicated to self-governing and radical environmentalism" that would fund "rural sustainable ecovillages in Hawaii and elsewhere."

That summer, Williams bought five houses on credit in what he calls Berkeley’s "’80s drug-war zones" and brought his Ann Arbor friends to California to turn his rundown properties into co-op material. Over the summer, the Green Plan became an official organization and Williams let its members live in his houses without paying rent. Instead, they were expected to pay monthly dues to their organization — roughly the equivalent of fair market rent — to put toward buying rural land or repurchasing the houses from Williams at cost. Those who couldn’t afford to contribute were allowed to stay free in exchange for working on the houses, doing extra work for the Green Plan, or volunteering in its Little Planet café.

"Sennet (Williams) tried to be clear that he wasn’t a landlord," says former Green Plan member Dianna Tibbs, but relations between Williams and the members quickly disintegrated. Three years after its formation, the Green Plan remained unincorporated as a nonprofit. A former member also said it was still too centered on Williams’ ideas. Williams’ relationship with the tenants soured. "Ultimately there was a rebellion among the people against Sennet," Tibbs says. In 1997 the project disbanded, transferring all of the money they had raised — about $50,000 — to the Little Planet café.

The Green Plan fell apart, but Williams was caught up in the fervor of the mid-90s real estate market. In 1997, he bought the house that would later be named Hellarity for $114,000, with the goal of "making it into a demonstration of an eco-house that would be an educational resource for the city." He says he chose that property in part so it "could be a tribute to the Black Panthers’ goals of providing food in the inner-city," as it was on the same block as the home of Black Panthers founder Bobby Seale.

But shortly after Williams bought Hellarity, he says he became "overextended in real estate." By the time he made his first mortgage payments, he says there were "over 60 people" living in his houses. He owned eight in Berkeley, two in Oakland, and was planning to buy farmland in Hawaii. With Williams tied up in too many projects to fix up Hellarity, he moved in some people to "house sit" in exchange for free rent.

Shortly after people moved in, Williams stopped coming around the house. The housesitters gradually brought in their friends, the walls were slowly painted to suit the eccentric tastes of the occupants, and more people started calling the house theirs. Williams said he didn’t invite them, but admits that he never asked them to leave. He had little contact with the occupants as years passed. "He was just a theoretical person that owned the house," DiCaprio says.

Hellarity took on a distinctly anarchist flavor in Williams’ absence. "People with alternative lifestyles and alternative family arrangements could live without having to dedicate their lives to making money, giving them more time to invest in their homes and their communities," says long-term resident Robert "Eggplant" Burnett, Bay Area punk rock legend, publisher of the zine Absolutely Zippo, and editor of Slingshot newspaper. Hellarity hosted the pirate radio station Berkeley Liberation Radio, a do-it-yourself bike shop, and cooked meals for Food Not Bombs.

It seemed like an anarchist paradise, but it wouldn’t last.

FOR SALE


By 2004, mortgage payments were driving Williams deep into debt, and Hellarity became a burden. The house was being pulled away from him from two sides: by anarchists who increasingly challenged the legitimacy of his ownership, and by creditors who placed liens against his properties.

When Hellarity was eventually sold by the court in a bankruptcy sale, the tenants say the man who would buy the house, Pradeep Pal, had never set foot in it. Pal, who refused to be interviewed for this article, lived in an upper-middle class neighborhood in Hercules and owned two businesses, Charlie’s Garage in Berkeley and European Motor Works in Albany. He wasn’t exactly a freewheeling real estate flipper — he was a South Asian immigrant who, according to Guardian research of property records, never owned real estate in the area other than his own home.

But to the tenants, Pal was a capitalist trying to buy them out of their home. In a recorded meeting with tenants, Pal admitted he hadn’t been inside the house before he bought it, and Williams tells us the real estate agent who arranged the sale also never toured the house before Pal bought it. "He obviously had no interest in moving into the place or contributing to the community if he didn’t even look at it," future occupant Jake Sternberg says. "This was someone who just wanted to make a profit."

The tenants made it clear to Pal that they didn’t want him to buy the house and would make life difficult for him. As soon as it became apparent that Williams would lose the house, Crystal Haviland and a few other occupants started searching for someone to help them buy the house. In the summer of 2004, the house was slated to go up on foreclosure auction, but the tenants hadn’t found a sympathetic donor.

The auction was set to occur on the steps of the René C. Davidson Alameda County Courthouse, and the occupants showed up banging drums and bellowing chants to warn off prospective buyers. "We wanted anyone interested in buying the house to know that the people who had been living at the house for 10 years wanted to buy it," says Haviland, who is now raising a child, studying psychology at San Francisco State University, and volunteering as a peer counselor at the Berkeley Free Clinic. "We didn’t want people to buy it and turn it into an expensive gentrified thing." While people gathered, Williams showed up and announced bankruptcy, a legal move that cancelled the auction.

With more time to search for financial support, Haviland started talking with Cooperative Roots, an organization that bought a couple of Williams’ other houses — now known as "Fort Awesome" and "Fort Radical" — in foreclosure auctions. Cooperative Roots is a Berkeley-based nonprofit organized in 2003 by members of the University Students Cooperative Association. They received money from progressive donors — mainly the Parker Street Foundation — to buy houses that they turned into "cooperative, affordable housing," says Cooperative Roots member Zach Norwood. Anyone who lives in their houses is an automatic member of the cooperative and makes monthly mortgage payments to the foundation.

For Hellarity, Cooperative Roots was a godsend. "Other people would walk into that house and say, "This place is disgusting," DiCaprio says. "But they said, ‘Wow, this is a work of art.’<0x2009>" The Parker Street Foundation was willing to put down whatever was needed to buy the house, Norwood says, but the occupants were limited by the monthly payments they could afford. On Nov. 4, 2004, the house went up for bankruptcy sale, and Cooperative Roots was prepared to bid up to $420,000. "It was exciting to be there with a bunch of crazy Hellarity people, putting out bids for hundreds of thousands of dollars," Haviland says.

No one expected them to show up at the sale. Williams says they had previously offered to buy the house from him but he "didn’t think they were serious." By the time they had the money, Williams no longer had control of the sale. At the courthouse, the anarchists were playing by the rules, bidding with money up front. The only other party interested in the house was Pal and his brother-in-law Charanjit Rihal, who were placing bids against the occupants. The two sides bid against each other, driving up the price until the occupants reached their limit. Pal and Rihal took the property for $432,000.

OWNERSHIP VS. CONTROL


"This sale was symptomatic of a housing market gone haywire," says DiCaprio. "People like Pal and Rihal thought they could just throw a bunch of money into real estate and it would always be a good investment. I’m glad the market finally crashed, because that kind of behavior hurts a lot of people. It ended up driving the price of housing to the point that normal people can’t buy anymore — and that’s absurd."

Pal soon discovered he owned the property on paper only. The occupants didn’t recognize the sale or his authority to tell them to leave. Three months after the sale, the occupants were still there, refusing to go. Pal took the case to court in an "action to quiet title," demanding that they be ejected from the property and that the title be freed from any future claims against it. He claimed the people in the house were squatters, living on his property without permission. But before the police could drag out the occupants, they countersued, holding themselves up in court without a lawyer for three years and living in the house the whole time.

One of the first cross-complaints came from Robert Burnett who — with his contempt for the computerized, cell phone-saturated consumer culture — wrote his cross-complaint on the back of a flyer on an ancient typewriter. When the document appeared in court, one side advertised a benefit for a pirate radio station at the anarchist info shop at the Long Haul with an image of tiny people being thrown out of an upside-down Statue of Liberty. On the other side, Burnett claims that he is a co-owner of the house, which he acquired through "adverse possession." Two other defendants made the same claim.

"Adverse possession transfers the ownership of a piece of real estate to people occupying the house without payment," says Oakland attorney Ellis Brown, an expert in property law. "In the state of California, you have to be openly living in a place for five years without the titleholder trying to make you leave to win an adverse possession case."

"Adverse possession originated to prevent Native Americans from taking back land from homesteaders, but squatters turned it around, using it to protect people who take possession of unused property," says Iain Boal, a historian of the commons who teaches in the community studies department at the University of California, Santa Cruz and the author of the forthcoming book, The Long Theft: Episodes in the History of Enclosure. Boal emphasizes the large numbers of squatters in the world, a figure Robert Neuwirth, author of Shadow Cities: A Billion Squatters, a New Urban World (Routledge, 2004), pegs at 1 billion. "It is only here that squatters are seen as bizarre leftovers from the ’60s," Boal says. "We are in a crisis of shelter, and people need to fill their housing needs."

DiCaprio concurs. Along with Burnett, DiCaprio was the main backer of the occupants’ legal case. As we talk in a dark, live-in warehouse, he sips coffee out of a Mason jar and looks over the court case on his laptop. He says he wants to be a lawyer, but he has never been interested in making lots of money — he says he wants to "fight for housing rights." DiCaprio learned squatter law while cycling through family law court, criminal court, and federal court over a Berkeley house he was squatting and trying to win through adverse possession. The city threw him in jail, and he was released just after Pal sued the occupants of Hellarity.

He says Hellarity was different from other situations he’s dealt with as a squatter. "We never thought of ourselves as squatters [at Hellarity] per se until Pal sued us and start using that language in court," he says. "Before he bought the house, no one was challenging our presence on the property. Sennet [Williams] was either actively or passively letting us stay there. By filing a claim to quiet title, Pal made it apparent the title was in question. By calling us squatters instead of tenants, they lost some claim to the property. So we took the ball and ran with it."

Their use of adverse possession was strategic, DiCaprio says, but they didn’t intend to win the house that way. "We were never under any illusion that we would win ownership of the house in court," he says. "We wanted to use the court as a forum to enable us to buy the house. We were just treading water until Pal got tired and agreed to sell." The occupants say they offered him $360,000 for the house, the price it was originally listed for, but he refused to take a loss on his investment.

DiCaprio says the courts generally aren’t sympathetic to squatters’ cases. "Pro pers tend to be poor, so there is a class bias against them," he says, referring to people who represent themselves without a lawyer. DiCaprio says judges have rejected documents for having dirt on them and refused to give fee waivers to people with no income. "The courts do not like squatters. If you mix pro per and adverse possession, you could not have a more hostile environment against us."

For more than two years, Pal and the occupants played a cat-and-mouse game, dragging out the case and trying to complicate it in hopes the other side would just give up. Pal’s lawyer, Richard Harms (who did not return Guardian calls seeking comment), objected to the terms "documents," "property," and "identify" when asked to produce evidence related to his claim. "Instead of trying to prove their case, they were just waiting for us to trip up and not file something before a deadline," says DiCaprio.

The occupants didn’t slip, but as the case wore on, he and Burnett grew tired of upholding their side in court. By fall 2007, the two cut side deals with Pal. Burnett settled for $2,000 and DiCaprio for an undisclosed amount. "I realized I couldn’t save it alone," DiCaprio says. "I told them to sink or swim."

ENDGAME


When Burnett and DiCaprio settled with Pal, the subprime housing crisis was splashing the headlines. Pal’s investment was starting to seem more like a loss, but for the first time since he bought the property, it looked like it would finally be his. By November 2007, the remaining squatters dropped the battle for ownership and began bargaining with him for concessions.

By mid-February, Pal was ready to start renovations, and all but two of the squatters had moved out. They made their final plea and Pal gave his last compromise: two more weeks, then they had to go. "He was sure he was going to get the house, so he agreed to let us stay," says a squatter called Frank, who asked not to be named because of his immigration status.

What Pal may not have understood was that he was not the only party still interested in the house. The house was becoming a point of contention among the larger community of squatters and anarchists in the East Bay. Fissures broke around a central question: was it up to those living there to decide the fate of the notorious squat, or did the larger community of radical activists have a say in the property?

As Pal was getting rid of the last people occupying the house, the squatters’ conflict came to Hellarity’s doorstep. A new group of people came to the North Oakland house, among them a few who had previously stayed at Hellarity, ready to renew the struggle against Pal. Frank, who had been living in the house for seven months, was unhappy about the new arrivals.

"I told them that this kind of action would make problems for me," he says. "I already made an agreement with this guy [Pal] to leave by the end of the month." The new group saw things differently. "We own this place," says Jake Sternberg, the new de facto caretaker of Hellarity, who has since been pushing for the squatters to renew their court case. The discord between the squatters split up the duplex: the two old squatters stayed upstairs while the recent arrivals occupied the lower half.

Two weeks after the new crew moved in, a fire was lit in the upper apartment that burned through the ceiling and the floor. But who did it? Was it a disgruntled squatter who would rather destroy the house than hand it back to Pal? Or was Pal connected to the arson, losing his nerve as a newly energized group of squatters took over and the value of his investment crashed?

If not for the squatters, Pal might have been less affected by the subprime crisis than most property owners. He had no mortgage on the house — he bought it outright — so he wasn’t under threat of foreclosure, unlike tens of thousands of other California homeowners. But Pal faced a different threat. It seems likely he bought the house as an investment, and as the market crashed, he was stuck with a house he could neither renovate nor sell, and was left to watch its value tank as he slogged through court proceedings.

For an investor like Pal, the numbers weren’t looking good. In March, median housing prices had fallen 16.1 percent compared with those of March 2007, according to DataQuick Information Systems, and home sales declined 36.7 percent from the previous year. In April — for the seventh consecutive month — Bay Area home sales were at their lowest level in two decades, DataQuick reported. And according to Business Week, national home prices will plummet an additional 25 percent over the next two to three years.

On Feb. 17, the day after the new group of squatters moved in, Pal made an appearance at the house. In early March, Sternberg showed me a video he recorded during Pal’s visit. On the screen, Pal is sitting on a couch in the downstairs living room of Hellarity. At the door, a well-built man who looks to be in his 30s and calls himself Tony leans against the wall with two younger men who call themselves Salvador and Ryan. Sternberg tells me that Pal came to the house demanding they leave his property. Sternberg called the police, accusing Pal of trespassing. As they waited for the OPD to arrive, which took more than 25 minutes, they discuss their conflict over the house.

At the beginning of the video, Sternberg tells Pal why he and his friends refuse to give up the property: "People came over here from Europe and they said, ‘Hey, we’re going to take this place.’ Now they sell land to each other. And how did they get it? They took it…. And just because somebody pays for something doesn’t mean that they get it. And just because somebody sells something doesn’t mean they have a right to sell that."

A few minutes into Sternberg’s video, Pal told the squatters he was ready to take matters into his own hands. "You just have to deal with me now because what I’m saying is, it’s person to person…. And you know what? If it’s gonna get dirty, it’s gonna get dirty. I don’t care. Because you know what? That’s the way it’s gonna be, because this is what I need. I need to have it. I don’t have any lawyer. I can’t afford a damn lawyer. So it’s gonna be me and you. One to one. Man to man."

Pal eventually left the property after the police arrived, but the two younger men, Salvador and Ryan, spent the night upstairs. "[Pal] had them stay there because they thought the people downstairs would squat the upstairs," Frank says. "He wanted to protect the house." Frank, who says he was concerned that Pal would try to evict him with everyone else, initially didn’t protest the presence of the two young men.

The next day, at Frank’s request, Pal told Salvador and Ryan to leave, and for the two weeks that followed, Pal didn’t return to the house. The new group of squatters expected to see him Feb. 28, the date set for a case hearing called by Pal’s lawyer prior to the re-occupation of the house. If the defendants didn’t show up, a default judgment could have been entered, granting Pal his request to have the squatters removed and ordered to pay $2,000 per month in back rent. The squatters showed up for court, but Pal’s side hadn’t filed the necessary paperwork to hold the hearing.

Once again the house hung in legal limbo and the day after the hearing, the remaining people upstairs moved out as agreed. Frank says Pal called him while he was at work that afternoon to make sure they were gone. For the first time in 11 years, the upper apartment was empty, waiting for either Pal or the other squatters to seize it.

But someone was committed to preventing that from happening. The night after the people upstairs moved out, at around 3:15 a.m., the squatters downstairs awoke to fire creeping through the floorboards above them.

"Both of the doors upstairs were locked," Sternberg says. "We broke through one of the doors and threw buckets of water on the flames."

After the fire department extinguished the blaze, the squatters called the police to have an investigator search the scene. "It appears that unknown suspects entered the house through unknown means, and then set three fires in an attempt to burn the house," the police report states. According to the report, all three fires were set in the upstairs apartment; two burned out before the fire department arrived. Officer Vincent Chen found two used matches in the bathroom, where the wood around the sink had been burned, and a gas can hidden in the bushes on the east side of the house.

When I first met Sternberg, he told me the Oakland Police Department’s arson investigator, Barry Donelan, was helpful. Two and a half months after the fire, however, Sternberg says: "I regret having talked to the police."

Initially, Donelan didn’t know they were squatters — Sternberg had told him they owned the house. "Once he found flyers for a fundraiser to defend the squat, he became angry," says Sternberg. "He said he submitted the case to the district attorney, and didn’t expect anyone would be arrested."

Sternberg says Donelan also threatened to have him arrested for a traffic-related warrant and that he would turn Sternberg’s name over to the Federal Communications Commission, which had an open investigation on the house for hosting Berkeley Liberation Radio. In March, Donelan told us he wouldn’t comment on the case and at press time, he hadn’t return Guardian calls about the status of the investigation.

EPILOGUE


Although the arson may never be solved, the squatters have strong suspicions about who was behind the fire. But they have a hard time deciding who, ultimately, is most culpable for the blaze. "No one involved in Hellarity is innocent, and no one is completely guilty," says DiCaprio. The one point of view everyone seems to share is that Hellarity has long been a tinderbox of contention, in which property owners struggling in a beleaguered housing market faced off against a group of people who reject the market outright for its inaccessibility to low-income people. Eventually, it all literally — burst into flames.

When I visit after the fire, people are sitting outside playing guitar, smoking rolled cigarettes, and singing the timeless hobo ballad, "Big Rock Candy Mountain." The sounds drift over the budding vegetable gardens and into the downstairs living room, where a message written on a big green chalkboard suggests that if the fire was intended to drive people out, it was unsuccessful: "WELCOME BACK TO HELL(ARITY). Because bosses, landlords, and capitalists suck, the house has lots of repairs that need to be done before it becomes fully livable."

Upstairs, Sternberg looks up at a charred, gaping hole in the ceiling. "We have to make lemonade out of lemons," he tells me, explaining that they just got a skylight to fill the cavity. "We’re going to continue fighting just like we’ve been fighting. This guy [Pal] has been in court with us for three years. He’s got no case." *
