Why did Mayor Newsom recently buckle three times to PG@E? How can he be a “green” mayor and a “green” gubernatorial candidate if he’s scared of PG@E?

Last Saturday (July 26), out driving in my car, I was startled to hear Mayor Gavin Newsom on the Progressive Talk Radio Show Green 960 show. He was the host, interviewing Stewart Brand of Whole Earth Catalog fame, and generally sweating away to appear clean and green, green, green, and green some more.
However, he greened over his recent classics in green self-immolation. So I sent him and the station some questions by email and then on to his press secretary Nathan Ballard. No answer as of blogtime almost a week later.

Dear Gavin,

I was interested to hear you this morning on the Progressive Talk Radio Green 960 program. I am curious to know why, as a purported “green” mayor and a purported “green” candidate for governor, and a “purported” radio host on a green 960 show, you have buckled twice recently to PG&E? The first time you buckled to PG&E and changed your position on the Potrero Hill peakers, allowing PG&E to continue to control the power plant and city energy policy.

The second was your quick and hard rejection of the clean energy initiative. How can you be a “green” mayor if you are buckling to PG&E on the big green issues? P.S. 1:And now there is a third Newsom instance of buckling to PG@E: Newsom’s five PG@E-friendly appointments to the San Francisco Public Utilities Commission. None had any public power or community choice aggregation credentials. And Nora Vargas, director of the Latino Issues Forum, was not only considered PG@E friendly, but PG@E between 2004 and 2005 had given $150,000 as part of their community grantmaking.

More: Guillermo Rodriguez, former public relations flak for PG@E, is on the board of the forum (along with two other private private utility executives. Rodriguez left PG@E to head the A. Philip Randolph Institute, which receives gobs of money from PG@E on a regular basis and in return provides “community services” for PG@E.

This, ladies and gentleman, is yet another example of how PG@E exerts its power and uses the mayor to subvert any real moves toward real clean and green power, such as the Clean Energy Initiative. PG@E has used this maneuver successfully for decades: they influence the mayor to make PG@E-friendly appointments to the PUC and then the PG@e-friendly appointees never put a pebble in the path of PG@E or raise serious questions about its illegal private power monopoly. So far, it’s always worked but a new day may be coming. On guard!

P.S. 2:Why doesn’t the station bring on people from the clean energy campaign? Why doesn’t it appear to allow call-in questions on the show (at least I didn’t hear any during my listening time?)

P.S. 3: Alert: Let us know of any PG@E astroturfing and greenwashing as the campaign goes along. PG@E is more worried than ever and it will be spending millions to try to convince San Francisco voters that clean green energy is not for San Francisco. Their propaganda line: leave the greening to PG@E and Gavin the Green. B3

Clean Energy Act makes ballot

GREEN CITY The San Francisco Clean Energy Act isn’t the only charter amendment on the November ballot, but it’s already shaping up to be the political lightning rod of this fall’s election.

Pacific Gas & Electric Co. sent out mailers opposing the measure even before the Board of Supervisors voted 7-4 on July 22 to place it on the Nov. 4 ballot. Mayor Gavin Newsom also announced his opposition to the act moments after Assemblymember Mark Leno, former San Francisco Public Utilities Commission General Manager Susan Leal, and a cadre of progressive supervisors announced their support for it on the steps of City Hall.

Authored by Sups. Ross Mirkarimi and Aaron Peskin, the Clean Energy Act requires San Francisco to fulfill 51 percent of its electricity needs through renewable sources by 2017. That requirement rises to 75 percent by 2030, and to 100 percent, “or the greatest amount technologically feasible or practicable,” by 2040.

The SF Clean Energy Act also mandates that a feasibility study be undertaken to look at the best way to provide clean, green energy, which could lead to PG&E losing its stranglehold on energy if the study finds public power to be the best option.

Explaining the importance of mandating a feasibility study, Mirkarimi said, “Otherwise PG&E has a monopoly here until the planet dies.”

Supporters say it is important for San Francisco to set up a model that others can follow. “As goes San Francisco, so goes the state of California, and so goes the nation,” Peskin said at the July 22 rally, just before the Board voted to place the act on the ballot. “This is a time when people can change the destiny of the planet.”

Moments after that rally ended, Mayor Newsom took a minute to explain his opposition.

“We have other things we should be focusing on,” Newsom told reporters at a press conference at the War Memorial Building to announce housing bonds for veterans. “Let’s call it what it is. It’s a power takeover of PG&E,” he said.

But the elected officials and myriad organizations who showed up at City Hall to support the Clean Energy Act say that public vs. private power is not the main issue.

“The public power considerations have been drafted in a thoughtful and reasonable way,” Leno told the crowd. “It would involve study after study after study, and testimony from experts.”

Leno noted that 42 million Americans have public power, and if San Francisco did turn to public power, it would be embracing something as American as mom and apple pie. “Unlike their private power company counterparts, public power systems serve only one constituency: their customers,” Leno said.

Sup. Gerardo Sandoval opined that government is better able to assume renewable energy risks. “The private industry is not going to take that risk,” Sandoval said. “It’s always going to take the cheap way out, which is fossil fuels.

Others warned the audience not to be swayed by PG&E’s anti–Clean Energy campaign, which Newsom’s chief political consultant Eric Jaye is working on.

“This is not some crazy takeover scheme,” Leal said. “It’s about protecting the environment and the rights of San Franciscans and their rate payers.”

The Clean Energy Act has been endorsed by the Sierra Club, San Francisco Tomorrow, ACORN, the San Francisco Green Party, the League of Young Voters, Green Action for Health and Environmental Justice, the San Francisco Green Party, and the Ella Baker Center for Human Rights.

Mark Sanchez, president of the San Francisco Board of Education and a supervisorial candidate in District 9, described showing “An Inconvenient Truth” to the eighth-grade science class he teaches. “What can I say to my kids — we don’t have the policies in place to mitigate the damage they see?”

The Sierra Club’s John Rizzo noted, “This act insures that San Francisco is at the center of this economy. Not in Japan, China, or Germany. It will be here.”

Aliza Wasserman of the League of Young Voters stated that “PG&E is not investing $1 in renewable energy beyond state mandates, and they lobby against measures to raise those mandates.”

It’s not an easy time to be celebrating. The Bush administration has driven the economy into the toilet. After more than five years, the nation is still fighting a foolish, unnecessary war in Iraq. Unemployment is rising, and so is the cost of living.

But it’s also been a banner year for grassroots democracy. Barack Obama, the antiwar candidate, the upstart, took on and defeated the vaunted Clinton operation, and did it in large part with little pieces. He raised millions from small donors and mobilized activists on the ground in a way we haven’t seen in too many years.

And that energy is alive and well in San Francisco. The city that defied Washington and forced the legalization of same-sex marriage, the city that remains the heart of the antiwar movement, will be leading the way toward a more sustainable energy policy this fall. District supervisorial campaigns are well underway, with the mobilizations and energy coming not from big campaign donors and powerful interests but from ordinary people who live here and care about their community.

That’s the spirit we celebrate in this Best of the Bay issue.

There’s a lot more democracy in our selections this year — more selections and ideas from our readers, more input from our community. Our cover art and the illustrations inside reflect the activist traditions and inspirations of this city.

It’s bleak out there in America, but hope lives in places like San Francisco. And that’s a great reason to be proud of all that is the Best of the Bay.

Going green requires cooperation

EDITORIAL There are some clear and compelling things San Francisco needs to be doing to protect the environment and reduce its carbon footprint, such as converting to renewable electricity sources and promoting alternatives to the automobile. But as the past couple of weeks at City Hall have demonstrated, city officials are letting petty politics interfere with working together to do the right thing.

Obviously, the most important step toward combating climate change is to convert the power portfolio of city residents to renewable energy sources. Nobel laureate Al Gore challenged the entire country to move toward 100 percent renewable power sources within 10 years during a landmark speech July 17.

But days later, when Gore appeared at the Netroots Nation convention in Austin, Texas, to repeat the challenge to the assembled bloggers, fellow guest speaker Mayor Gavin Newsom came out against the San Francisco Clean Energy Act, which would set even more modest goals for conversion to green power sources.

Newsom’s reason, as Sarah Phelan and Janna Brancolini explain in this week’s Green City column, is fear of provisions in the legislation that call for studying — just studying — public power options for achieving these goals. Considering Newsom has repeatedly told the Guardian that he supports public power, it’s disgraceful that he’s so beholden to Pacific Gas and Electric and so mindlessly adversarial toward the Board of Supervisors that he would oppose setting high green power standards.

But Newsom isn’t the only one playing this game. Board president Aaron Peskin is trying to scuttle Sunday Streets, which would temporarily close six miles of roadway to cars as part of an international trend to promote carfree spaces, simply because it was Newsom who proposed it (see "Pedal power," 7/23/08).

True, Newsom is a newcomer to the carfree movement — having spent years blocking proposed street closures in Golden Gate Park — but his conversion was warmly embraced by progressive groups such as Livable City and the San Francisco Bicycle Coalition and should have been supported by Peskin and other supervisors.

Meanwhile, the city is doing little to fight the ongoing court injunction against bicycle projects even as required environmental work on the Bicycle Plan falls behind schedule. In connection with a July 21 hearing on that delay, both Planning Director John Rahaim and City Attorney Dennis Herrera have called for reform to the California Environmental Quality Act (CEQA) and for changes in how the city interprets traffic impacts under the act.

"It’s truly ironic that an activity that is inherently environmentally friendly is being challenged under an environmental law," Rahaim said of bicycling as he testified before the Land Use Committee. He’s right. City officials should aggressively move forward with the local reforms under consideration and push the bureaucracy to keep the Bike Plan on the fast track.

Meanwhile, our state legislators should work to amend CEQA to exempt pedestrian and bicycle improvements from costly and time-consuming environmental impact reports and our federal representatives should start laying the groundwork now to ensure next year’s big transportation bill reauthorization promotes alternatives to the automobile.

As a gesture of cooperation and goodwill, Newsom should come out and support Sup. Chris Daly’s latest proposal to close Market Street to automobiles, which would greatly speed up public transit, improve pedestrian safety, and create an attractive bicycle boulevard in the heart of the city.

The idea was first pitched by former mayor Willie Brown and has already been studied and vetted by the city bureaucracy. This could be the first big cooperative project between the board and the Mayor’s Office, a team effort against the forces of the status quo. And if it is successful, just imagine what they could take on after that.

Realism about Russia

BERLIN – Russia’s strategy to revise the post-Soviet order in what it calls its “near abroad” will be pursued with even more perseverance following its victory over Georgia. Europe should have no illusions about this and should begin to prepare itself. But, as the European Union ponders what to do, cold realism, not hysterical overreaction, is in order.

Unfortunately, equating the current situation in the Caucasus with the Soviet Union’s invasion of Czechoslovakia in 1968 does not attest to this kind of realism. Neither the West nor NATO constitutes the decisive strategic threat facing Russia, which comes from the Islamic South and from the Far East, in particular the emerging superpower, China. Moreover, Russia’s strength is in no way comparable to that of the former Soviet Union.

Indeed, demographically, Russia is undergoing a dramatic decline. Apart from commodity exports, it has little to offer to the global economy.

Notwithstanding booming oil and gas revenues, its infrastructure remains underdeveloped, and successful economic modernization is a long way off. Likewise, its political and legal system is authoritarian, and its numerous minority problems remain unsolved. As a result, Russia’s current challenging of the territorial integrity of Georgia might prove to be a grave error in the not-so-distant future.

Given this structural weakness, the idea of a new Cold War is misleading. The Cold War was an endurance race between two similarly strong rivals, the weaker of which eventually had to give up. Russia does not have the capacity to wage another struggle of that type. Nevertheless, as a restored great power, the new Russia will for the time being attempt to ride in the slipstream of other great powers for as long as doing so coincides with its possibilities and interests; it will concentrate on its own sphere of influence and on its role as a global energy power; and it will otherwise make use of its opportunities on a global scale to limit America’s power. But it will not be able to seriously challenge the United States – or looking towards the future, China – in ways that the Soviet Union once did.

It is now clear that in the future, Russia will once again pursue its vital interests with military force – particularly in its “near abroad.” But Europe must never accept a renewal of Russian great power politics, which operates according to the idea that might makes right. Indeed, it is here that Russia’s renewed confrontation with the West begins, because the new Europe is based on the principle of the inviolability of boundaries, peaceful conflict resolution, and the rule of law, so to forgo this principle for the benefit of imperial zones of influence would amount to self-abandonment. Further eastward expansion of NATO, however, will be possible only against fierce Russian resistance. Nor will this kind of policy in any way create more security, because it entails making promises that won’t be kept in an emergency – as we now see in Georgia.

For too long, the West has ignored Russia’s recovery of strength and was not prepared to accept the consequences. But not only Russia has changed; so has the entire world. America’s neo-conservatives have wasted a large part of their country’s power and moral authority in an unnecessary war in Iraq, willfully weakening the only global Western power. China, India, Brazil, Russia, and the Persian Gulf today are the world economy’s new growth centers and will soon be centers of power to be reckoned with. In view of these realities, the threat of exclusion from the G8 doesn’t really feel earth shattering to Russia. Europe’s disunity and impotence underline this image of a West that has partially lost touch with geo-political realities.

The response to the return of Russia’s imperial great power politics has nothing to do with punishing Russia, and a lot to do with establishing innately Western – especially European – positions of power. This requires several measures:

• a new political dynamism vis-à-vis Turkey to link this country, one crucial for European security, permanently to Europe;

• putting a stop to Moscow’s divide-and-conquer politics by adopting a common EU energy policy;

• a serious initiative for strengthening Europe’s defense capabilities;

• a greater EU commitment to Ukraine to safeguard its independence;

• a greater freedom of travel for all the EU’s Eastern neighbors.

All of this, and much more, is needed to send a clear signal to Russia that Europe is unwilling to stand idly by as it returns to great power politics.

Presumably, none of this will happen, and it is precisely such inaction that is, in large part, the cause of Russia’s strength and Europe’s weakness. At the same time, however, one shouldn’t lose sight of the joint interests linking Russia and the West. Cooperative relations should be maintained as far as possible.

It is blatantly obvious that for Russia’s elites, weakness and cooperation are mutually exclusive. Therefore, whoever wants cooperation with Russia – which is in Europe’s interest – must be strong. That is the lesson from the violence in the Caucasus that Europe must urgently take to heart.

PG&E’s PUC appointee

The Rules Committee of the Board of Supervisors voted Monday to forward the appointment of Nora Vargas to the SF Public Utilities Commission, without recommendation. The three supervisors on the committee (Tom Ammiano, Chris Daly, and Bevan Dufty) all expressed concern that Vargas’ lack of experience with local politics and public utilities issues might be a setback should she fill the seat.

Vargas is director of Latino Issues Forum, a statewide nonprofit advocacy group, with offices in Fresno, Los Angeles, and San Francisco. LIF works on healthcare reform, educational issues, and consumer rights for immigrants and Latino populations. Vargas would fill the ratepayer advocate seat on the PUC.

Vargas, when questioned by the Rules Committee, said she felt confident of her ability to act independently of her appointing authority, Mayor Gavin Newsom, and that she would put ratepayers and consumers first. When asked if she’d be able to push back against powerful entities like Pacific Gas and Electric, which takes an active interest in many things the SFPUC control, Vargas cited her experience advocating on behalf of ratepayers at the California Public Utilities Commission.

We know PG&E likes to spread their money and influence throughout the city. In this case, between 2004 and 2006, PG&E has given $150,000 to Latino Issues Forum, as part of their community grantmaking.

This is the same kind of giving that would presumably end should San Francisco voters approve the Clean Energy Act this November. “We no longer will be contributing to San Francisco’s non-profits and service organizations,” PG&E’s Brandon Hernandez told a June 27 meeting of the Rule Committee, at which they voted to put the Clean Energy Act on the November ballot. The measure calls for San Francisco to move toward 100 percent clean and renewable energy, possibly through public construction and ownership, thus putting PG&E out of business in this city.

Additionally, Guillermo Rodriguez, Jr., former public relations flak for PG&E, is on the board of Latino Issues Forum (along with two other private utility executives.) Rodriguez left PG&E to head the A. Philip Randolph Institute, which also receives lots and lots of PG&E’s money on a regular basis.

Vargas’ appointment to the SFPUC is up for approval by the full Board of Supervisors at today’s meeting, along with Newsom’s four other appointments – Ann Moller Caen, FX Crowley, Francesca Vietor, and Dick Sklar. Sklar, at the last PUC meeting, withdrew his candidacy for the seat.

We arrived in Chicago’s Union Park at the tail end of a 15-hour drive. Or, more specifically, the tale end of a one 15-hour drive, one backwoods Maryland carnival crabcake, one unfortunate bout of heat stroke, 12 too many energy drinks, three regretful sausage biscuits, and yet another 15-hour drive. But we arrived.

Just in time to hear the delightfully over-the-top punk whine of “All I wanted was a Pepsi” floating over from the Connector stage. Soon Mission of Burma’s Roger Miller, after chiding himself for being too old, was telling the patchy crowd, “Everybody put on your dancing shoes,” before knocking out a few strums and reconsidering, “OK, take ’em back off. It seemed like such a good idea to do that one, but as everybody out there knows, the next song is …”

Why does track order matter? Because this was Friday night, July 18, at the Pitchfork Music Festival, and the influential Boston post-punks had been invited by All Tomorrow Parties’ “Don’t Look Back” series to enlighten a new generation of hipsters with their 1982 opus, Vs. Enlighten they did: although the audience was still filtering in, Mission of Burma wooed even the reluctant Jumbo-tron watchers waiting for Public Enemy on the Aluminum stage.

Summing up SF’s historic rally for clean energy

It was a historic rally Tuesday on the City Hall steps to kick off the third initiative aimed at bringing clean energy and public power to San Francisco.

As our photo essay shows, there was a formidable and diverse array of politicians and environmental and social justice organizations lined up with their signs and speeches to support the measure.

Five supervisors, including the board president, spoke at the rally (Ross Mirkarimi, Aaron Peskin, Tom Ammiano, Bevin Dufty, and Gerardo Sandoval) and then went into a board meeting in City Hall and hours later voted with two other colleagues (Sophie Maxwell and Chris Daly) to put the pioneering initiative on the November 2008 ballot. The vote was 7-4, with Sups. Sean Elsbernd, Michaela Alioto-Pier, Carmen Chu, and Jake McGoldrick voting against. The rally and the vote were cannon shots heard round the city, the state, and the nation.

Susan Leal, former general manager of the SF Public Utilities Commission, made her first public appearance since her dismissal by Mayor Newsom, at the urging of PG&E, for her moves toward public power. The Sierra Club, which fought the damming of Hetch Hetchy Valley in Yosemite National Park a century ago and still wants to tear the dam down, was standing tall with the group (John Rizzo).

All in all, it was one of the most impressive starts to a tough initiative campaign that i have seen in 42 years of covering City Hall for the Guardian. More: having covered the clean energy/public power beat since l969 and our first expose of the PG&E/Raker Act scandal, I think this initiative and this emerging campaign has an excellent chance of winning in November. Remember: when the public power movement revved up in the late l990s, it faced a PG&E-friendly mayor (Willie Brown), a PG&E friendly City Attorney (Louise Renne, whose husband worked for a downtown law firm getting big PG&E money) and a PG&E-friendly Board of Supervisors (only Tom Ammiano and the late Sue Bierman were pro-public power) and had to go around City Hall by going the route of a Municipal Utility District (MUD) ala the Sacramento Municipal Utility District (MUD). This time around, the board turned against PG&E and the city attorney’s office drafted the initiative for the board president and an emerging mayoral candidate.

The November ballot is filled with the juicy issues that bring out the voters: Obama, seven supervisorial races, and a raft of good initiatives aimed at dealing with major city problems (an affordable housing plan, two new tax plans focused on bringing in revenue from the wealthy, a big bond act to rebuild San Francisco General hospital, and the green energy and public power plan.) This time around, clean energy and public power are in the news and the media carried the story widely. PG&E is more worried than ever before and is already launched an early carpet bombing campaign and setting up astroturf and greenwashing operations allegro furioso. And their operatives are out and about and lurking everywhere. On guard!

Assemblyman Mark Leno: “Jimmy Carter predicted 30 years ago that by 2000 we could be down from 40 per cent dependence on foreign oil to 20 per cent dependence. We didn’t listen. Instead we were up to 60 per cent by 2000 and now we’re pushing 70 per cent…This measure will take our fate out of PG&E’s hands and put it into the hands of our communities, who have a profound stake in providing clean, sustainable, reliable, and reasononably priced electric services.”

What the candidates need to tell us

EDITORIAL The traditional kick-off date for fall campaigns is Labor Day, but in San Francisco, the candidates for supervisor have been in full campaign mode for months now, and some of the races are beginning to take shape. As political groups start making endorsements, it’s worth looking at what’s at stake here — and what the candidates ought to be talking about.

For starters, it’s going to be a crowded fall ballot, and there’s the potential for a broad progressive coalition to come together around a clear agenda for the future. Among the proposals headed for the ballot are an affordable housing plan, a green energy and public power measure, two new tax plans that focus on bringing in revenue from the wealthy, and a huge bond act to rebuild San Francisco General Hospital. All of the progressive candidates should be backing those measures and working together for their passage.

But the candidates also need to offer long-term solutions to the serious problems facing San Francisco. This is a city under enormous pressure, and unless some dramatic policy changes take place, San Francisco will continue its rapid slide toward becoming a city of and for the very rich.

A few items that ought to be on every progressive candidate’s platform:

<\!s>The city’s energy future. The fall ballot measure, the Clean Energy Act, will lay the groundwork for a sustainable local energy policy, although the supervisors will have to aggressively push the key element: creating a city-run electric utility. As long as Pacific Gas and Electric Co. controls the local grid, San Francisco will never meet its environmental goals. Rates will remain high, conservation will be an afterthought, and PG&E will resist any type of renewable program it doesn’t control. The candidates need to make clear that they’re committed to a full-scale public power system and tell us how they will move the goals of the Clean Energy Act forward.

<\!s>The housing crisis. San Francisco’s housing policy today is utter insanity. If it continues, the city in 10 years will look nothing like it does now. The middle class will be gone. Families with kids will be a vanishing species. Tens of thousands of people who work in this city — and keep its economy going — will be forced to live far away. Fancy new towers filled with millionaires will destroy entire neighborhoods and displace the city’s remaining blue-collar jobs.

The affordable housing ballot measure is a good first step, but much more is needed. Solutions aren’t easy, but they start with one premise: the city doesn’t need any more housing for the rich. Affordable-housing programs that set aside, say, 20 percent of new units for non-millionaires are a losing game because they accept as reality the prospect of a city where 80 percent of the residents are millionaires.

San Francisco needs a comprehensive policy that forces the city to meet its General Plan goals, which call for 64 percent of all new housing to be available at below-market rates. We need to hear how the candidates would make that happen.

**The structural budget deficit. San Francisco is a wealthy city, but there’s never enough money in the budget for the level of services residents want and need. With the exception of the rare boom years, the city has always had a revenue shortfall. Sup. Aaron Peskin’s two tax measures could bring in another $50 million per year — no chump change by any means. But the city needs about $200 million more per year to make the numbers balance. The candidates need to talk about where that will come from.

**The Muni meltdown. You can’t have a transit-first policy without effective transit, and Muni’s in trouble. Budget cuts are a big part of the problem, but the city needs a modern transit program — and that’s barely even on the drawing board. How are the candidates going to fix one of the city’s most important services? Will the candidates support the long-overdue completion of the city’s bicycle network and other bold efforts to decrease reliance on the automobile?

**The war on fun. As the city gets richer, it gets more uptight. Street fairs are under attack. Clubs are facing police crackdowns. Permit fees and red tape are making it almost impossible to hold events in Golden Gate Park. Sup. Ross Mirkarimi has a ballot measure to make some of the permitting easier, but what are the candidates going to do to end the Gavin Newsom–era attack on arts and entertainment?

There’s much more: The police aren’t solving homicides. Small businesses feel utterly ignored by City Hall. The Planning Department is run by developers. The list goes on. And the next Board of Supervisors will need to address all those issues. Over the next few months, the candidates that want the progressive vote need to give us some clear explanations of where they stand.

If there was ever a doubt that Elizabeth Falkner had a thing for Orson Welles, her new restaurant — named Orson — should lay to rest any lingering uncertainties. Falkner’s first venture, a bakery called Citizen Cake, first appeared in the late 1990s in a northeast Mission District space (near Rainbow Grocery) now occupied by Chez Spencer. After a few years it moved to considerably posher quarters in the performing arts quarter while retaining its Wellesian moniker.

But even the upscaling of Citizen Cake, including its expansion to a full-scale, full-service restaurant, could not begin to prepare people for the strange wonder of Orson. (Orson is a fine name, but am I alone in being reminded first not of Orson Welles but of Orson Bean, the character actor who’s turned up in all sorts of movies and TV shows over the years?) The restaurant’s design doesn’t offer much in the way of clues, either. It’s very au courant SoMa: large and lofty, with a huge wall of exposed concrete, a mezzanine, swaths of industrial carpeting on the floor, and a persistent hiss of ambient sound, as if a huge white-noise machine in some hidden corner had been turned up to "loud" but not "very loud." The noise doesn’t preclude conversation, but, like cigarette smoke, it’s impossible to ignore. Perhaps this is the new standard.

So we have a SoMa restaurant with a whimsical name, bearing a general physical resemblance to other SoMa restaurants with whimsical names and run by a woman whose reputation is rooted in high-style baking and what we might call classic California cuisine. And we find, on the menu of that restaurant, a dish called parmaggiano pudding ($5), an ivory-colored custard presented in a crock. The idea of a savory flan made with parmesan cheese might seem like plenty of cleverness for one dish, but Orson’s kitchen, under the guidance of Falkner and chef de cuisine Ryan Farr, isn’t likely to be called complacent. They are full of wild and wacky ideas, such as lacing the parmesan pudding with cocoa nibs. The wonder is not that a few of these gambits fail — they do, spectacularly, like some of those early space shots in which the rocket collapses in flames or whizzes off in the wrong direction — but that so many of them so sensationally succeed. The parmesan pudding is only one such success.

The only dish on Orson’s rather complex menu I would describe as a total flop is the foie bonbon ($5), a chocolate truffle filled with a buttery pâté de foie gras. One by one, the faces around our table wrinkled in distaste after a nibble, and while I didn’t hate the bonbon, I did think it was a bad marriage between incompatible elements that had nothing more than richness in common.

On the other hand, the jolt of espresso in the potato cream bathing the short ribs ($15) was, like the cocoa nibs, a cunning bit of counterpoint, adding depth, mystery, and a little smokiness to what might otherwise have been an ordinary soupy sauce. (Leaves of braised spinach brought some color but were texturally uncooperative; they reminded me of sails left in choppy water by a capsized sloop.) And the egg atop a pizza ($14) of tomato, crisped guanciale, chile flakes, and robiola cheese was less out of place than it looked — and it looked quite out of place, as if there’d been some kind of head-on collision in the kitchen. But the yolk drained nicely across the pie (imagine flooding a rice paddy, in miniature, with yellow paint) and added a nice note of velvetiness to what was otherwise a rather brash Neapolitan pizza.

Not all the food is eccentric. A boudin noir pizza ($14), for instance, was topped with (in addition to the blood sausage), arugula, oregano, and thin slices of potato — a perfectly genteel combination you might find at any number of places. Garganelli ($11) — pasta tubes that looked like mottled cinnamon sticks — were tossed in a simple sauce of basil and splinters of summer squash. A sprightly kimchee ($5) was festooned with throw pillows of fried tofu. Chicharrones ($5), a.k.a. pork rinds, arrived in a tall cup looking like twisted French fries suitable for dipping in the shallow tub of barbecue sauce on the side. And a chicken beer sausage link ($14), although accompanied by flecks of nectarine, whispers of frisée, and a hint of pistachio, was satisfyingly all about the sausage.

Some of the exotic touches were discreet to the point of being unnoticeable. Actual French fries ($7) were cooked in duck fat and presented with a small ramekin of browned butter béarnaise, a subtle aioli alternative. Tongue ($5), never an easy row to hoe, was transformed into a golden-crusted, nicely rectangular croquette and served with cherries and what might be one of our most underappreciated greens, purslane.

Does all this sound like the stuff of DIY tasting menus, a sequence of memorable bites? The glory of DIY is the randomness of it — we’ll have a few of those and one of that — but for more orderly types, Orson does offer four formal tasting menus that consist of three to five courses and cost from $50 to $65. One is vegetarian, another pork-based. Caveat: your whole table must participate. Tables for two have several additional "for two" options, though Orson doesn’t really strike me as a restaurant for couples. Its pulsing energy is that of a crowded club for the young and the restless, whose packs are forever rearranging themselves. It’s easy to picture them talking about movies. But do they talk about, or have they even seen, Citizen Kane?

SF Weekly bashes the left — and misses the point

I’m not surprised that Matt Smith is once again looking for ways to bash the left, and that the SF Weekly is once again looking for ways to attack public power. But Smith’s latest piece is really screwy.

His thesis seems to be that the public-power movement is supporting the move to build city-owned power plants at the foot of Potrero Hill. Actually, that’s completely wrong.

There’s a measure headed for the fall ballot called the Clean Energy Act that would, among other things, move the city toward public power. But it has very little to do with the battle over the power plants.

The two cosponsors of the Clean Energy Act, Ross Mirkarimi and Aaron Peskin, are on opposite sides of the power-plant issue. And even a cursory read of the Guardian blogs demonstrates that the activists are by no means of one mind on this.

The whole idea that the peakers were a public-power plot is pretty laughable, since NONE of the leading public-power activists had anything to do with the idea in the first place. (And later, when it came out of the SFPUC — which again, has NEVER been a bastion of public-power activism) some of us liked the idea and some of us didn’t.

And the Peskin measure that Smith talks about has nothing to do with public power either.

High speed rail on track

It’s crunch time for high speed rail in California, a project 12 years in the planning that will finally go before voters in November, following a controversial July 9 vote in San Francisco on the system’s Bay Area alignment and ongoing political struggles in Sacramento.

As envisioned by project proponents, riders would be able to board the sleek blue-and-gold trains in San Francisco’s remodeled Transbay Terminal and travel at speeds of up to 220 mph down the Peninsula, cutting over Pacheco Pass into the Central Valley, and arriving at Union Station in Los Angeles two hours and 38 minutes later — or continuing on to Anaheim and arriving 20 minutes after that.

The $9.95 billion bond measure, Proposition 1, would cover about a third of the costs for this initial phase (the plan would eventually extend the tracks to run from Sacramento to San Diego), with the balance borne almost equally by the federal government and private investors. With around 100 million passenger trips per year, and LA-SF tickets projected to cost around $60, fiscal studies show the project will more than pay for itself in less than 20 years, then generate about $1 billion a year in profits.

Perhaps most important in these times of heightened environmental concern, the system is now proposed to run entirely on renewable energy sources and would use about onethird of the energy of air travel and one-fifth that of driving, eliminating 18 billion pounds of greenhouse gases from the atmosphere and reducing California’s oil dependence by 22 million barrels per year.

Yet there are still obstacles that could derail high speed rail, which was set in motion in 1996 by then–state senator Quentin Kopp, a San Franciscan and retired judge who chairs the California High Speed Rail Authority (CHSRA).

Critics of the CHSRA’s unanimous vote choosing Pacheco Pass over Altamont Pass are threatening to sue and now have about 30 days to do so. Union Pacific Railroad has complicated the right-of-way acquisition process by claiming it won’t allow the project on its property. And Gov. Arnold Schwarzenegger and his allies have been inconsistent in their support for the project (see "Silver bullet train," 04/17/07).

On top of that, legislation to update the six-year-old language of the bond measure, Assembly Bill 3034, appeared at Guardian press time to have fallen short of winning needed support on the Senate floor before the July 15 deadline set by Secretary of State Debra Bowen. And there was a renewed effort by Republican legislators to try to push the bond measure back to 2010.

Yet for all the challenges the project continues to face, the recent hearings in San Francisco demonstrated that there is a consensus emerging among some of the most powerful political players in the state that California is finally ready to catch up to Europe and Asia and start building the first high speed rail system in the United States.

CHSRA met in San Francisco July 8-9 to take public comment and finalize its last critical decision before the November bond measure — selecting the train’s route through the Bay Area and making the legal and environmental findings to support that decision. The stakes were high as the board weighed whether to select Pacheco Pass or Altamont Pass as the route from the Bay Area to Central Valley.

CHSRA staff and consultants, along with most Bay Area politicians and civic groups, favored Pacheco Pass, which is the faster and cheaper option, and one that doesn’t require a logistically difficult crossing of the San Francisco Bay to reach the Peninsula.

Most environmental groups favored Altamont Pass, which avoids ecologically sensitive Henry Coe State Park and areas where activists feared the rail line might induce urban sprawl or threaten agricultural viability. The conflict seemed intractable just a few months ago, with South Bay politicians threatening to oppose the project if it used Altamont and organizations, including the Sierra Club, threatening litigation if Pacheco was chosen.

But it appears that project proponents have allayed many of the environmentalists’ concerns by eliminating a proposed rail station in Los Banos or Avenal and including strong preservation policies in the project.

"We have worked with as many of these individuals as we could to accommodate their concerns," CHSRA executive director Mehdi Morshed said at the hearing, noting that they’ve done all they could to make changes and still have a sound project. "We can’t deal with the dogma. Some people say you must do this or else, and we can’t deal with that."

After years of studying the options, Morshed said the choice is clear.

"Pacheco is the appropriate corridor for fast intercity rail service," Morshed told the CHSRA board. "Somewhere along the line, we have to decide we’ve studied enough and move on, and this is one of those circumstances."

Most of the dozens of people who spoke at the hearing agreed, including Tim Frank, who represented the Sierra Club of California and praised CHSRA staff for addressing most of the group’s concerns.

"The opportunity to get people out of cars and out of airplanes and get them into steel wheels running on steel track is very important," Frank said, noting that the project was essential to meeting the state’s goals for reducing greenhouse gas emissions.

Yet others are still threatening litigation, among them Oakland attorney Stuart Flashman, who addressed the hearing on behalf of clients that include the Planning and Conservation League, the California Rail Foundation, and the Mountain Lion Foundation. He made a number of technical points about the project’s environmental impact reports, such as the use of alignment corridors rather than more specific routes.

"We find your report completely inadequate," Daniel McNamara, project director for the California Rail Foundation (a train users group), told CHSRA.

After the vote didn’t go his way, Flashman told the Guardian that the coalition he represents will meet soon to decide what’s next. They have 30 days from when the notice of decision was entered July 9 to sue unless the Attorney General’s Office waives the statute of limitations. "We’re going to be considering what to do now, but litigation is certainly on the table," Flashman said.

Whether filed by this group or another entity, the CHSRA has been working closely with Deputy Attorney General Christine Sproul to create a project that will withstand a legal challenge.

"We wanted to make sure that if and when there is a lawsuit — and there probably will be a lawsuit — that we are capable of defending it," Morshed told the board, noting how Sproul was brought in because of her expertise in environmental law.

Before the authority voted, Sproul explained that the environmental documents are for the overall program to build the project and are therefore not as detailed as the specific project studies that will be performed after CHSRA secures specific property to build on.

"Today, before you is really a broad policy choice," she said.

Sproul also said that the project is likely to proceed even if a lawsuit is filed, noting that getting an injunction to stop the project would require the litigants to secure a bond against losses to the state as it pursues this high-dollar project, "which could be millions."

But recent CHSRA actions have appeased many of the would-be plaintiffs and created a project that was effusively praised by stakeholders.

Mayor Gavin Newsom said San Francisco is "very supportive" of the project and will work to make it a reality. "We stand behind your efforts to bring high speed rail to the state of California," Newsom told CHSRA, later adding, "We need to connect the state to itself."

Newsom said San Francisco International Airport officials support the project. While it might seem to be a competitor, Newsom said high speed rail will take some of the pressure off SFO, which would otherwise experience congestion at problematic levels by 2020. Current plans call for a high speed rail station at SFO, as well as one near Palo Alto.

"We recognize that we need to have competitive modes of transportation," Newsom said. "Our airport is very supportive of this effort, and that’s very important."

Board of Supervisors president Aaron Peskin echoed the point, noting that he began his political career as an activist opposed to filling in more of the bay, something an airport expansion would probably require. He told the authority that his board has unanimously endorsed the project.

Jim Lazarus, vice president of the San Francisco Chamber of Commerce, also announced that group’s support for the project, telling the authority that Californians have long been ready for high speed rail: "I think the public is ahead of the politicians in Sacramento on this one."

Many of the speakers spoke knowledgably about high speed rail.

"I’ve ridden on the Japanese Shinkansen and I can’t wait to ride on the first high speed rail system in the United States," said Dean Chu, a commissioner with the Bay Area’s Metropolitan Transportation Commission.

"I’ve been building high speed rail systems for 15 years in Asia and Europe, and I just want to say, ‘It’s about time’," said Robert Doty, the rail operations manager for Caltrain, who has worked in Germany, England, Taiwan, and China.

Echoing that sentiment was Eugene K. Skoropowski, who also worked on high speed rail projects in Europe before taking his current job as managing director for the Capital Corridor Joint Powers Authority: "It’s about time we bring our American firms that have expertise (on building high speed rail systems) back home to work here."

Enthusiastic supporters of the project urged the authority the move quickly.

"We feel a great deal of urgency over this project," said Emily Rusch, a San Francisco–based advocate with the California Public Interest Research Group.

"Everyone I talk to is very excited about the idea," said San Francisco resident Mary Renner. "It’s embarrassing that we’re so far behind the rest of the world, and I just want to tell you the public is supportive of this project."

"Our priority is to get this thing built and get it built quickly," said Dave Snyder, transportation policy director for the San Francisco Planning and Urban Research Association. "Let’s get rolling on high speed rail."

The final step in getting high speed rail ready for the November ballot was to be AB 3034, which sought to update the language and financial oversight provisions of Prop. 1, whose language was written for the election of 2004 before changes in the project.

"I feel good and I’ll feel better when AB 3034 is in appropriate condition," Kopp said after the vote on the Bay Area alignment.

Kopp was critical of Sen. Leland Yee for amending the bill to guarantee the bond money went to the San Francisco to Anaheim section, something Yee said he did to protect San Francisco’s interests but that Kopp felt hurt the measure’s statewide chances. Yet that tiff was overshadowed by the bill’s apparent and unexpected failure in the Senate.

Sen. Mike Machado (D-Stockton) was unhappy with the Pacheco choice and decided to oppose the project, meaning that proponents needed three Republican votes to win the two-thirds needed for passage and only Sen. Abel Maldonado (R-Santa Maria) was willing to cross party lines, Capitol sources told the Guardian.

Secretary of State Debra Bowen had set a deadline of July 15 for substituting the new language in Prop. 1, so at Guardian press time it appeared the old language would remain in place, which Kopp said was acceptable and probably wouldn’t hurt the project.

Meanwhile, a project opponent, Roy Ashburn (R-Bakersfield), sought to kill Prop. 1 by doing what’s known as a "gut and amend" to an unrelated bill, SB 298 by Senate Minority Leader Dave Codgill (R-Modesto), in an attempt to push the bond measure back to 2010.

If he can find the two-thirds vote in both houses — which most sources consider unlikely — it would be the fourth time the bond measure has been delayed. So barring any unusual political deals, the high speed bond measure is still up in November.

If a majority of voters approve Prop. 1, the CHSRA would begin negotiating rights-of-way and working on final technical studies. Construction could begin as early as 2010, although completion could take up to 10 years.

In the meantime, CHSRA unanimously voted to work with regional rail agencies such as BART to create a rail system over Altamont. As Morshed said, "We need to immediately start working on the Altamont corridor and find a solution to that."

Self-help books

ISBN REAL In a recent, much-discussed Washington Post op-ed, Twelve publisher Jonathan Karp said, "There are thousands of independent publishers and even more self-publishers. These players will soon have the same access to readers as major publishers do, once digital distribution and print-on-demand technology enter the mainstream. When that happens, [major] publishers will lose their greatest competitive advantage: the ability to distribute books widely and effectively."

The "widely" Karp refers to is an advantage that major publishers lost a long time ago. A physical copy of the latest Robert Ludlum novel is far less accessible to the global community than Joe Shmuck’s online prose poem about his first drug experience. It’s the "effectively" that’s taking its sweet-ass time to materialize. After all, thanks to the ease of e-distribution, the Internet has already become a cosmic slush pile.

Karp foresees a time when the glut of options for disposable entertainment will make brand-establishment for "formula fiction" a less successful strategy, leaving attention to quality as the only way for a major publisher to stay relevant. On the contrary, it seems to me that the agoraphobic variety offered by the Internet would make brand-establishment quite successful for a major publisher. Maybe it’s defeatist thinking, but I wonder if the only truly exciting possibility for seekers of uncompromising work in the near future is that smaller enterprises might have a better chance to survive alongside the larger ones. Maybe the practical hope is that the eventual normalization of "digital distribution and print-on-demand technology" might be sufficient to sustain the talented independent writer of modest financial expectations.

One potential beneficiary of this modest revolution is novelist Carl Shuker, who is publishing his brainy horror experiment Three Novellas for a Novel all by his lonesome at www.threenovellasforanovel.com. This month, Shuker — a New Zealander now living in London — has made the second of the three titular installments, ?O Hills Park, available for download. Also available is the first novella, The Depleted Forest, about an editor in an alternate-present Japan who is proofreading the computer-translated memoir of a member of a secret society of rape-tourists. The third installment, Beau Mot Plage, will be uploaded soon. For the PDFs, he’s charging — à la Radiohead — whatever you want to pay.

Since Shuker has already published two well-regarded novels (2005’s award-winning The Method Actors and 2006’s The Lazy Boys), he’s not exactly at the bottom of the slush pile. But he’s not Radiohead, either. More to the point, while The Depleted Forest is a relatively accessible and not unmarketable story, ?O Hills Park is the kind of thing only an Internet could love. It’s the full memoir excerpted in the first novella and presented in the quasi-English of computer translation. Rushed to publication to catch the public’s fleeting interest in the first book’s sex scandal, the text of ?O Hills Park is as much a mesmerizing word puzzle as an intriguing piece of fiction. It’s also a supremely ironic comment on the publishing culture from which the work was spared — the culture whose cathartic rehabilitation Karp is so optimistic about.

It’s doubtful either Karp or Shuker is making that culture hang its head in shame. Back when writers with a taste for food and shelter were at the mercy of those with the exclusive means of wide distribution, they had no choice but to pretend publishers answerable to stockholders had an obligation to publish works with all the mass appeal of a conscript military. It’s always been an honorable delusion, but it may be that such an insistence is now a waste of the energy that should be spent learning how to cut out the middleman.

Biennialmania

Biennials, triennials, and whatever other rotation of years, are place-based exhibitions. They obviously happen somewhere, and the place dictates the context. The "Whitney Biennial 2008," for example, focused on "American art," an increasingly ambiguous term — in recent years the show has included growing numbers of artists with hyphenated identities. "Today there are more artists working in more genres, using more varieties of material, and moving among more geographic locations than ever before," reads the blurb on the Web site for this year’s edition. "By exploring the networks that exist among contemporary artists and the work they create, the Biennial characterizes the state of American art today."

That sense of international movement seems to be informing the shape and scope of biennials everywhere, creating curatorial fashions that are almost predictably inventive — and often place structural concepts ahead of visual appeal. The West is riding a surge of art surveys, and you just have to skim the institutional rhetoric to sense how complicated, or perhaps rote, the idea of location has become.

The current Site Santa Fe biennial in a very identifiable New Mexico location is a salient example. It was created by the curator/organizer, Lance Fung, who contacted curators at alternative spaces around the world and asked each to recommend artists. The 22 selected artists and collectives were commissioned to produce ephemeral "site-inspired" projects. As the release notes, "All the works are created on site, and are informed by this specific locale and the surrounding Santa Fe environs…. Much of the show has actually occurred prior to the opening, on the ground in Santa Fe, and prior to that, in virtual space, as ideas, proposals, and thoughts that have been transmitted around the world." The show contains just one collaborative team that lives in Santa Fe.

According to its Web site, Yerba Buena Center for the Arts’ fifth triennial "Bay Area Now" exhibition, opening Saturday, July 19, "explores questions around how to re-imagine a regional survey in the midst of globalization." The Bay Area is an interesting case in this regard because it is a fairly self-enclosed, self-defined site — and unlike the Santa Fe show, few people will travel to San Francisco just to see "BAN 5." Curators Kate Eilertsen and Berin Golonu tackle this formidable scenario with a cross-generational, cross-disciplinary gallery exhibition and four guest-curated shows that "will diversify ‘Bay Area Now”s curatorial vision and extend the artwork beyond the walls of our galleries and beyond the confines of our region." It remains to be seen how successfully they meet the challenge.

It’s interesting to compare "BAN 5" rhetoric with that surrounding the "2008 California Biennial," which opens in October at the Orange County Museum of Art. (Full disclosure: I contributed a short interview to the catalog.) "How does one approach a regional biennial?" states the promotional literature on the show’s Web site. "In a climate of globalism and transnationalism, how does a regional biennial serve artists and audiences? What is distinctive and different about cultural production at this point in time, in this context? How does one approach contemporary artistic practices based on locational parameters?"

The "CAB," organized by Lauri Firstenberg, will also stage off-site projects at venues such as Estación Tijuana, an independent exhibition space in Tijuana, Mexico, and SF’s Queens Nails Annex, a space that hosts BAN 5 as well. Extending an exhibition’s geographical reach is admirable and interesting, though those efforts may fracture these shows and make them harder to see — one wonders, if you just make it to Queens Nails, will you really see "BAN 5" or "CAB"?

The parallels are distinct and reflective of the zeitgeist. But as much as we’d like to think these exhibitions are about now, they most directly reflect the years in which they were organized. America will be getting a new president, but it’s shrinking from rising fuel costs and economic woes. In such an environment, regional identity — think locavores — most likely will grow stronger. Here’s hoping "BAN 5" captures some of that energy.

Nature — in its many contrived or bizarrely hybridized forms — has ways of rearing its at-times-grotesque, at-times-seductive heads in Misako Inaoka’s work. Are her cunning mutants little monsters — be they chirping mechanical birds with propeller beaks or flowery pincushion pates, or donkeys or cattle mermaid-merged with John Deere tractor parts? Miniature extras from a lost installment of Ultraman? The petit-four-size stuff of surrealist nightmares? Or bio freaks in search of a new species to call their own?

It’s easy to get carried away by the puckish black humor of these critter creations or simply their kawaii — or cute — qualities, before sinking deeper into Inaoka’s query into the nature of authenticity vs. artifice, an idea that also crops up in her mossy or AstroTurfed environments, one of which will receive prominent placement in the glass-enclosed hall facing Mission Street during "Bay Area Now 5." "I’m interested in the way we mimic nature to create an urban landscape. When we can’t have access to real nature, we have AstroTurf. Or these birds that people purchase for amusement or as a pet," says the deeply tanned, elfin 31-year-old in the sweltering Dogpatch studio she shares with about six other artists. "Even I forget when I go to the park. I think, ‘Oh, this looks beautiful and smells great and looks green.’ But it’s all manicured."

If, in less than four decades, humans are expected to vault beyond pacemakers and merge with machines and some form of artificial intelligence, thereby erasing distinctions between organic, animate beings and inorganic, inanimate objects, as scientists like synth inventor Ray Kurzweil have theorized, then Inaoka’s small sculptures — created by chopping apart dollar- and toy-store creatures and reconfiguring them with resin, toy parts, and flower-store detritus — resemble harbingers of the new hybrids we all might be rushing toward in the quest to adapt to a rapidly shifting environment. "This is my fantasy — what if they can change quickly and if they could adapt easily," says Inaoka, as she shows me another piece she created specifically for "BAN 5" (she also has work in Stephen Wirtz Gallery’s "Summer ’08" group show, through Aug. 23): white birch branches scattered with silver-coated bird-mods sporting jet wings, machine parts, and, in one case, a walker.

The Kyoto, Japan, native received her BFA from the Rhode Island School of Design and her MFA from Mills College, where, on that beauteous, highly controlled campus, she first began to experiment with making moss-clad environments. Since then her work has received its share of stereotypical responses: comparisons to Zen gardens, ikebana, or bonsai. But Inaoka prefers to find inspiration in common, everyday objects she might find in her Mission District habitat: a tree-shaped cell phone antenna or the little flowers that push through the cracks of the sidewalk. "I try not to think too much," says Inaoka of her process. "I just make and make like I was five years old again. Then the thinking process or research follows. ‘Why did I make this shape? Why did this come up?’ When I have too many concepts, it just kind of kills the energy."

GREEN CITY Environmentalists are pondering the state’s seemingly schizophrenic approach to fighting climate change after a recent state report encouraging increased use of mass transit came out at the same time that the governor’s budget proposal denies the state’s public transportation fund more than $1 billion.

The California Air Resource Board’s June 26 Draft Scoping Plan to combat global warming, released pursuant to Assembly Bill 32, the California Global Warming Solutions Act of 2006, is at least the second major report this year to recommend expanding public transit. But the governor’s latest spending plan redirects that sizeable chunk of money — gasoline tax revenue that voters who approved Prop. 42 in 2002 directed toward transportation projects and agencies — to help reduce the state’s $17 billion budget deficit.

"There’s a lot of misallocation of resources going on," said Tom Radulovich, executive director of the San Francisco nonprofit Livable Cities. "The governor on the one hand wants to say, ‘You should all ride mass transit.’ But on the other hand, he is taking away [transit] support from the state budget."

The governor’s press secretary, Aaron McLear, said the budget proposal spares transit from cuts faced by other programs during these tough economic times.

"Funding for public transportation stays level in the governor’s budget proposal. That’s in the face of a $17 billion deficit. The fact that it remains level is better than a lot of cuts we’ve had to make," McLear said. "We wish we could increase it, because it certainly is something the governor believes in. But again, the state is facing a $17 billion shortfall. We can only spend the money that we have. There will have to be some tough decisions to be made."

The CARB plan calls for California to lead by example by encouraging state employees to take advantage of public transportation during their commutes. It notes that transportation accounts for 38 percent of California’s greenhouse gas emissions, most of which comes from cars and trucks, and that curbing these emissions is critical to reaching California’s goal of reducing total emissions by 30 percent over the next 12 years.

"Overall I think this is headed in the right direction. For better or worse, this really does put California ahead of any other state if we fully implement this plan. Of course, having a good plan does not guarantee that it will be implemented, but this is a very serious attempt," said Gabriel Metcalf, executive director of the San Francisco Planning and Urban Research Association, of the state’s global warming plan.

Yet he also said that reaching the plan’s ambitious goals for reducing greenhouse gases means people will have to drive less and use transit more, and that local governments will need to stop approving urban sprawl projects.

"The easy answer that most Americans would rather have is to keep driving just as much as always, but have alternative fuels. And that just is not going to work. AB 32 has a major land use change component. Is it enough? No, it is not. But it is at least an acknowledgment of what we have to do," Metcalf said. "Overall I’m pretty impressed, but they’re not proposing enough land use change and they’re not proposing transit funding increases. They are still unwilling to face facts about the role of the automobile and climate change."

Yet instead of increasing funds for mass transit, the governor has redirected billions of public transportation dollars into the general fund, maintaining status quo transit funding in the face of increased gasoline prices and the new climate change mandate. At the same time, billions of dollars have been allocated to highway expansion programs, exacerbating the global warming problem.

"Anybody’s budget should be a reflection of their values, whether it’s an individual or an agency," said Carli Paine, transportation program director for the Transportation and Land Use Coalition. "The state is saying, ‘We value public transportation as a climate friendly choice.’ Yet when it comes to expressing those values in the budget, we say, ‘It doesn’t matter that much,’ so we’re actually undermining those original statements."

The governor’s revised state budget allocated $306 million to the State Transit Assistance Program, the state’s source of funding for mass transit operating costs such as maintenance, drivers, fuel, and mechanics.

This is the same amount that was allocated last year, even though transit ridership is the highest it has been in more than 50 years, according to a June report by the American Public Transportation Association. And factor in that crude oil is about $140 per barrel now compared to about $73 per barrel this time in 2007, according to the Energy Information Administration, a federal agency. "The budget is kicking transit in the teeth when it needs it [money] the most," Radulovich said.

The $306 million allocated to the State Transit Assistance Program comes from funds generated by Prop. 42, the voter-approved gasoline tax measure. But Paine said the STAP should also be entitled to what is called "spillover" money. Spillover refers to additional funds generated when the price of gas rises faster than inflation on other goods, leading to unusually high revenue from the tax.

The governor’s budget predicts $1.77 billion in spillover for the 2008–09 fiscal year, but he decided to put the money toward shrinking the deficit instead of funding public transportation. The current fiscal year was the first time since the proposition passed that the spillover did not go toward public transportation.

Radulovich said he believes the state is hesitant to fund mass transit — even though it recognizes the importance of reducing the number of cars on the road — because building more roads and freeways leads to more expansion and urban sprawl.

"Sprawl makes a lot of people a lot of money," he said, including oil companies, car companies, homebuilders, construction firms, and trucking companies. "These are political questions, not policy questions. The policy answers in many ways are very clear. The question is whether there is the political will to deal with it, and that’s what we’re going to find out."

Radulovich said this reality is why many California business groups support outward expansion and put pressure on the government to fund highways over mass transit. The Bay Area Council, for example, pushed aggressively for highway expansion during the last budget cycle.

Paine said she believes political pressure also comes from structural flaws in the state’s budget system.

"It’s the legacy of Prop. 13, which really froze the income our state received from [property] taxes," she said. "Public entities that are committed to social services, such as education, are still receiving property taxes at levels that are decades behind what they used to be." This puts a strain on the state’s general fund, and money has to be diverted from the mass transit account to relieve the burden generated by California’s low income tax levels, Paine explained.

Paine said a new budget proposal has been submitted to the California legislature that would restore hundreds of millions of dollars to the mass transit account for the 2008-09 fiscal year by generating additional revenue for the general fund. She said that since 2000, more than $3 billion of mass transit money has been redirected to the general fund, and the number will exceed $4 billion if the governor’s current proposal goes through.

"This isn’t just a problem this year — it’s a chronic problem. And public transportation is chronically being leaned on for relief," she said. "It’s just not a sustainable system."

TRANSIT FUNDING 101

Carli Paine of the Transportation and Land Use Coalition explained the finer points of California’s complicated system for funding — or not funding — improvements to the public transit system. Transit’s main account is called the State Transit Assistance Program. This money is flexible, but is mostly used for transit operations (maintenance, operations, fuel, mechanics, drivers, and so forth). Sometimes, though, it is used for capital projects (such as buying new tracks or replacement cars).

The STAP is the largest portion of the public transportation account, and the funding is critical. As Paine put it, "If you can’t even operate the system that you have, it doesn’t help much to have money to lay new tracks." The STAP is therefore often the focus of discussions about transit funding.

Prop. 42, which directs California’s gas tax to transportation projects, funds the STAP, although not all Prop. 42 money goes there. For example, 25 percent of Prop. 42 revenue goes to a special account for transit capital projects.

Prop. 1B is another big source of transit funding. It is the 2006 measure that allowed California to sell $19.9 billion worth of bonds to fund transportation programs. Only about $4 billion of that was allocated to public transportation, with the lion’s share of the money going toward new freeway projects.

This is where things get a little complicated.

California originally had a sales tax on all goods except gasoline. In the 1970s, voters passed Prop. 42, which decided that it would be more equitable to reduce the sales tax rate by a fraction of a percentage point, but expand the sales tax to include gasoline.

This was expected to be revenue-neutral for the state, so it wouldn’t cost people more. That was true unless gas prices rose quicker than the cost of all goods, which it eventually did.

Then-Gov. Ronald Reagan argued that it was important to return the extra revenue to public transportation because when gas prices rise, more people use public transit. As a result, this "spillover" has been set aside for transit expansion.

Last year was the first year in which the spillover was diverted to the general fund instead of being given to the STAP. It was redirected to help close the state deficit, and the 2008–09 budget proposes doing the same thing this fiscal year. (Janna Brancolini)

Back in 2001, San Francisco came within 500 votes of approving a public power system in an election marred by lingering evidence of fraud. Ballot boxes were removed from the Department of Elections (under a bizarre, never-documented threat of anthrax poisoning) and box tops were later found floating in the bay. I still think we actually won that election. And it’s hard to see how we could have done it without organized labor.

The Central Labor Council backed public power. Service Employees International Union Local 790 poured resources into it. The labor-environmental coalition that came together around building a city-run system that would rely on clean energy was unprecedented.

Pacific Gas and Electric Co. knows this. That’s why the company is trying mightily to keep labor from backing this year’s Clean Energy Act. And at the center of that battle is Mayor Gavin Newsom’s chief political consultant and close advisor, Eric Jaye.

The Clean Energy Act, as we point out on page 5, would give the city control of its energy future and put San Francisco at the forefront of national efforts to reduce carbon emissions. It also opens the door to public power — and Jaye has been hired by PG&E to try to keep the supervisors from putting it on the ballot, and to defeat it if they do.

He has a powerful weapon to use: labor’s determination to pass a giant bond act to rebuild San Francisco General Hospital.

A billion-dollar bond act is a tough sell, and harder still during a recession. Labor is also making a big push for progressive supervisorial candidates in Districts 1, 3, and 11. And the labor council director, Tim Paulson, tells me that he really wants to keep the city’s disparate and sometimes fractious labor unions united around those goals.

The International Brotherhood of Electrical Workers, PG&E’s union, will oppose any public power measure, any time, no matter what it says, and IBEW walked out of the labor council in 2001 over the issue. Now Jaye is telling labor people that the Clean Energy Act (and other issues that are "crowding" the ballot) may undermine public support for the hospital bond. "I have an early poll showing that these other measures have a negative impact on the hospital," Jaye told me. "I have been pointing to that fact and asking if we really need to do [the Clean Energy Act] this year."

John Whitehurst, who is running the SF General bond campaign, says his polls show that there was no correlation between an affordable housing set-aside measure and the hospital bonds, and presumably the same is true of the Clean Energy Act. On the other hand, he says, "if Jaye runs a campaign that says ‘Gee, the city can’t do anything right,’ it could create problems for the hospital measure."

Would Eric Jaye threaten the SF General bonds (which his client, Gavin Newsom, strongly backs) to keep labor from backing public power? He insisted to me that he would never do that, and that he and the mayor fully back the bonds. But PG&E, I think, cares nothing about the hospital — or the city — and will do whatever it can to scuttle this measure.

So will labor be intimidated by the threat of divisiveness (from the IBEW) and the political scare tactics from PG&E — or will labor leaders tell the mayor to knock it off?

Newsom and the Clean Energy Act

EDITORIAL A progressive measure that would make San Francisco one of the greenest cities in the nation will be on the ballot this fall. It’s designed to lower energy costs, reduce greenhouse gas emissions, and promote green-collar jobs. It has all the elements that Mayor Gavin Newsom has been talking about in his high-profile speeches, press conferences, and celebrity appearances. It’s a perfect vehicle for a mayor who wants to stand out as a candidate for governor of California. It has the backing of some of Newsom’s close allies, like state Sen. Mark Leno.

That’s why Newsom ought to support the Clean Energy Act.

The charter amendment, sponsored by Sups. Aaron Peskin and Ross Mirkarimi, seeks to make San Francisco more energy independent. It sets ambitious goals for renewable energy and would put the city on track to create its own public power system. It’s not a radical measure — in fact, it’s milder than we would have liked. It doesn’t mandate an immediate takeover of Pacific Gas and Electric Co.’s facilities. It doesn’t turn the Public Utilities Commission into an elected body. And no matter what lies PG&E puts out, it won’t raise electric rates or cost the taxpayers money.

It does, however, mandate that the PUC look at the best ways to ensure that by 2017, 51 percent of the electricity used in the city comes from renewable resources. By 2040, that number should be 100 percent. And the evidence from across the nation shows that the best way to promote renewable energy is to shift from private control of utilities to public power.

Again, that’s hardly a radical notion: more than 2,000 cities in the United States have public power. Palo Alto is among them; so are Alameda and Santa Clara. The Sacramento Municipal Utility District provides reliable service to Sacramento County at rates 30 percent below what PG&E charges customers in adjoining areas — and SMUD has one of the best records in the nation for promoting conservation and renewable energy.

Of course, the very existence of any sort of plan to consider energy alternatives for San Francisco seems to terrify PG&E. Already the giant private utility is pulling political strings and retailing outrageous lies to try to scare the supervisors away from placing the charter amendment on the ballot. And we expect to see a savage, multimillion-dollar campaign against the measure this fall.

That’s because PG&E wants no hint of competition, no chance that the city might actually consider the benefits of public power. It’s no secret why. When you look at the facts, compare how public and private systems have fared in the past decade, and line up the financial figures and the prospects for sustainable energy policies, public power wins.

The biggest misinformation PG&E is putting out these days involves the cost of creating and running a public power system in San Francisco. The company is throwing out numbers like $4 billion, and suggesting that the taxpayers would be on the hook for all of it if the city tried to take over the company’s system.

For starters, there’s nothing in the Clean Energy Act that requires a takeover. It might turn out to be more prudent, for example, to slowly build a new city-owned infrastructure. More important, if the city did decide to buy out PG&E’s wires, poles, and meters, the cost would be nowhere near what the company is claiming.

How much is the system really worth? Well, one way to find out is to check the assessed value, the figure the state uses for property-tax purposes. And as Amanda Witherell reported July 2 (see "The dirty fight over clean power"), the state says all of PG&E’s property within San Francisco city limits is worth only $1.2 billion — and that includes the company’s downtown office complex, which is worth at least several hundred million. So the actual cost of the system might wind up at less than a quarter of what PG&E claims.

And none of that money — none — would come from taxpayers. The PUC could issue only revenue bonds, backed by future electricity sales, to finance any buyout or construction. No tax money would ever be in play. And our past analyses have consistently shown that the city could buy out PG&E’s system, cut electric rates, and still wind up with a sizable surplus every year.

Newsom is aware of all of this, and has said that he’s willing to consider supporting public power. Now there’s a measure heading for the ballot that would also mesh with all of the mayor’s environmental goals. The only argument against it is that PG&E — in the past a backer of the mayor — doesn’t want it to pass.

Newsom needs to support the Clean Energy Act. If he doesn’t, it will demonstrate that he lacks the backbone to stand up to special interests — and has no business running for governor of this state.

Don’t kill the peakers — yet

A GUARDIAN EDITORIAL

The supervisors are meeting a day late this week, thanks to the San Francisco Examiner’s screw-up, which means that a key vote on the city-owned combustion turbines, or peakers, will probably come Wednesday, July 16. The mayor, with some environmental backing, wants the board to kill the city peakers and leave Mirant Corp, a private power company, with the responsibility of generating extra electricity in San Francisco during peak use periods. That’s the worst possible scenario.

We recognize the contradictions inherent in any city plan to construct new fossil-fuel generation plants. San Francisco ought to be moving away from any energy solution that increases carbon emissions, and if the city wants to simply ban any facilities that burn anything to generate electricity, we would by sympathetic.
But that’s not the choice here. The mayor (and Pacific Gas and Electric Company) want to continue using natural-gas-fired turbines to generate electricity in southeast San Francisco. They just want a private company, not a public agency, running the plants.

And we’ve seen no legally binding, written guarantee that Mirant will close its big, polluting Unit 3 under the deal.
There’s some dispute about whether Mirant will operate cleaner peakers than the city, but there’s no dispute about the fact that a private company will be far less accountable than a city department that will soon by run by commissioners who must be approved by the supervisors. And if the city kills the peakers, it will have no leverage at all over what Mirant might be required to do.

The supervisors need to leave their options open here and hold off on killing the public-power peaker plan until the public can see, review, and participate in hearings on binding agreements for the future of Mirant’s plant. As Potrero Hill activist Tony Kelly, who has been working on this issue for years, put it in an email to us:
“I have to emphasize that a vote in favor of the CTs tomorrow doesn’t have to lock the city into the CTs; there’s already an amendment to the ordinances giving the city an out in case another program (Mirant retrofit, or transmission only) turns out to be better. However, if tomorrow’s ordinances fail, or are tabled, then the CTs go away as an option. That’s the problem.

Because it really looks like the PUC will formally rescind the public CTs next Tuesday, in their last act of defiance and corruption; and that will kill the public CTs, and then Mirant holds all the cards to do whatever it wants to do from then on.”

Again: We’re open to a solution that involves neither the city-run peakers nor Mirant. But we’ve been around long enough to know that when the mayor, PG&E and a private power-plant owner are mucking around with energy policy, you have to be very, very careful before you trust what comes out of the discussion. We don’t trust Mirant for a second, and the supervisors shouldn’t give up the city’s leverage too early.

The following is an email exchange between me and Nathan Ballard, the mayor’s press secretary, on the subject of the Clean Energy Act. It raises some interesting questions; I thought I’d just post it without further comment.

ME: Will Mayor Newsom be endorsing the Clean Energy Act?

ME: Thanks, I will. A private political consultant is now speaking for the mayor on policy positions?

BALLARD: I don’t use public resources/time to comment about endorsements on ballot measures, candidate races, etc. Eric Jaye is Newsom’s point of contact for the media on such issues.

ME: Interesting. How long as this been your policy? (And by the way, I don’t think the Clean Energy Act is a ballot measure yet. It’s still before the board of supervisors. So you can’t speak for the mayor about his positions
on pending legislation?)

I’m also intrigued by the possibility of serious conflicts here. Eric Jaye is often involved in local political campaigns as a paid consultant. Should he be speaking for the mayor if he is getting paid to take one side on an issue?

BALLARD: Yes, I can speak for the Mayor on pending legislation. Once it’s on the ballot, I probably shouldn’t. Anyways, I don’t know of any local legislation called the Clean Energy Act. Do send me the text and I’ll see
if the Mayor wants to express an opinion to you about it.

As to your question about Eric Jaye, it sounds like you are suggesting that he is doing something wrong. I know and respect Eric, and so I know that you are on the wrong track. His professional ethics are unimpeachable. But
instead of spreading rumors about Eric through third parties, why don’t you just pick up the phone and call him with your accusations? I am confident that he will be quite happy to set you straight.

ME: Eric Jaye informs me that since he is, in fact, working for PG&E in opposition to the Clean Energy Act, he has a conflict (as I had suspected) and can’t speak for the mayor on this issue.

There was a hearing on the measure this week, and I’m sure the mayor is aware of it and what it entails. Can you let me know if he has taken a position or plans to?

Youth gone wild: Black Tide

Who better to embody the spirit of mayhem than a posse of rock-crazed teenaged boys? Especially if it’s capital-M Mayhem, which happens to be the name of a package tour of metal bands sponsored by crack-tastic Rockstar Energy Drink?

The show, which hits the Shoreline on Saturday, July 12, with a roster of bands both horns-worthy (Mastodon!) and ehhh (Five Finger Death Punch?), signals the local debut of Black Tide, a quartet whose chief source of notoriety thus far is that they’re fronted by a 15-year-old (their oldest member just turned 20). Yep, you read that right: though they’re the same age you were when you got your first job at Jamba Juice, this gang of Miami whippersnappers has a deal with Interscope Records and are currently touring the world to promote their new album, Light from Above. What gives? Do we have a metal Hanson on our hands, or what? And would they kill me for suggesting as much (duh)? I called up bassist Zakk Sandler mere hours after Black Tide played their first Mayhem set at tour’s kickoff in Seattle, Wash.

If public power can work in Rock Rapids, Iowa, why can’t it work in San Francisco?

When I came into yesterday’s public hearing at City hall on the emerging clean energy act initiative, I wasn’t surprised to see the room stacked with people obviously rounded up by PG&E for the occasion. After 42 years of covering PG&E, I know how private utility operates.

I asked the man sitting next to me, obviously not a
City Hall regular, why he was attending the hearing. His answer was vague but he was obviously agitated about the clean energy act initiative. Was he going to testify against the initiative? Yes, he said. Was he paid to attend the hearing?
He mumbled a bit and then said, yes, $50 bucks. But, he pointed out, he hadn’t been paid yet.

The word got around the hearing room that PG&E’s going rate for this hearing was $50. Julian Davis, the chair of the clean energy campaign, was first up to testify and promptly mentioned the going rate.
He then said that he considered it “cynical and tragic” for a corporation like PG&E to take advantage of communities of color into advocating on behalf of an agenda that ultimately does not serve their interests. (Many of the members of the audience were persons of color. Davis is black.)

Many of them testified, arguing that the initiative, which calls for setting renewable energy goals and making San Francisco the nation’s greenest clean energy city, would be too expensive and burdensome and ought to be killed forthwith. They testified that they couldn’t afford higher electric rates, higher taxes, higher anything in the city’s tight economy. Several said they were living on fixed incomes and simply could not afford another penny on anything.

Sup. Ross Mirkarimi, sponsor of the bill, and Sup. Chris Daly, chair of the rules committee meeting, Sup. Bevin Dufty, and many pro-clean energy speakers pointed out the many advantages of clean energy and public power. Cities with public power across the state and country had lower electric rates, better service, and extra money for their general funds. The Sacramento Municipal Utility District (SMUD) is a national leader in renewable energy and conservation efforts, while still keeping its rates far below PG&E rates in adjoining communities.

After hearing the clean energy speakers, several people came up to Davis after the hearing and said they were confused and annoyed that they had been misled by PG&E. They were interested in the arguments for clean energy and the initiative and wanted to know more.

Davis said he told them, among other things, that “one of the essential components of the clean energy act is a mandate to offer the kind of jobs and job training in the clean energy industry that PG&E is not currently offering to the very communities they are willing to exploit to promote their status quo agenda.” The jobs idea was of particular interest, he said.

And, yes, I testified at the hearing. I sometimes do this to counter the time worn PG&E line that, gosh, golly, gee, electricity is so complicated, city workers are so lazy, dumb, and incompetent, how in the world can they run an electrical company if they can’t make the muni run on time. Wheeze, wheeze, and wheeze again.

And so I pointed out that in my hometown of Rock Rapids, Iowa, population 2,800, a bedrock conservative Republican farming community way out in the northwestern part of the state,
the town has successfully operated a public utility since l896, and it’s doing just fine. It provides good, reliable, hometown electricity, has good low rates and excellent service, makes money for the general fund and subsidizes projects such as the local swimming pool, and doesn’t gratuitously cut off service with no way to appeal or complain, as is PG&E policy. And the public utility is locally accountable to a local board of directors composed of local townsfolk, such as my old friends Dave Foltz, a local real estate man, and Eugene Metzger, a local banker.

To this day, I told the supervisors, II always carry in my pocket a little blue coin purse that eloquently makes the local point. And I pulled the purse out of my pocket and read the inscription to the supervisors: “Call before you dig, Rock Rapids Municipal Utilities, (7l2) 472-2513.)”

And so my central argument is unbeatable: If public power works in Rock Rapids, Iowa, why can’t it work in San Francisco, California? PG&E has yet to get back to me on this one. Meanwhile, I’ll keep you posted throughout the campaign on public power in Rock Rapids. On guard, stay plugged in for the duration, the fun has just started, B3
