Redefining radicalism

› news@sfbg.com The Ella Baker Center for Human Rights has a 10-year history — which it marked Sept. 14 with an anniversary gala in Oakland — of aggressive opposition to police abuse, racism, economic injustice, and the get-tough policies that have created record-high incarceration rates. Those problems have only gotten worse over the last decade, despite some significant successes by the group in both Oakland and San Francisco. But these days, founder and director Van Jones sounds more like a hopeful optimist than an angry radical. “When we first got started, our politics were more about opposition than proposition,” Jones told the Guardian. “We were more clear what we were against than what we were for.” An organization once prone to shutting down the halls of power with sit-ins is now working on prison reform legislation, doing antiviolence public education campaigns, and promoting the potential for a green economy to revitalize West Oakland and other low-income communities. “Now, I’m in a place where I want to see the prisoners and the prison guards both come home and get some healing,” Jones said. Some of that transformation comes from Jones’s evolving critique of progressive political tactics, which he has come to see as ineffective. “Our generation would be better if we had a little less New Left and a little more New Deal.” But the change was also triggered by a personal epiphany of sorts following his unsuccessful effort to stop the passage in 2000 of Proposition 21, which sent more minors into the adult correctional system. “I went into a major depression and I almost quit being an activist,” Jones, an attorney who turns 38 this month, told us. “It was a very personal journey, but it had a big impact on the Ella Baker Center.” The change has made allies of former enemies, like radio station KMEL, which was vilified for selling out the Bay Area hip-hop culture after Clear Channel Communications purchased the station, but which is now helping the Ella Baker Center spread its antiviolence message. The center has also attracted a new breed of employees to its ranks of 24 full-time staffers, people like communications director Ben Wyskida, who moved here from his Philadelphia communications firm last October. As he told us, “What drew me to the Ella Baker Center was this message of hope.” Jones has a critique of the problems and those in power that is as radical as ever, noting that authoritarians have taken power and essentially dismantled our democratic institutions. But he’s moved from diagnosis to prescription, telling us, “I think the ‘fuck Bush’ conversation is over.” His new approach hasn’t always gone over well with his would-be allies. Environmental groups including Greenaction boycotted Mayor Gavin Newsom’s photo-op posturing during World Environment Day last year, and they were critical of Jones for validating the event and using their absence to grab the media spotlight for his green economy initiatives. But Jones tells us he doesn’t get rattled by criticism that he’s playing nice with the powerful because he remains committed to helping the underclass. “The most important thing is to know who you’re for and know your history.” And if the group’s 10th anniversary black-tie celebration in the Oakland Rotunda was any indication, the Ella Baker Center has more support now than at any other time in its history. The guest list for the event was a veritable who’s who of every major political, grassroots, and environmental organization on the West Coast. Guests included Code Pink cofounder Jodie Evans, Mother Jones publisher Jay Harris, and actor-activist Danny Glover. “Radical means root — that’s what we have always been addressing,” Jones told us at the event. “We used to spend a lot of time pointing out the hurt in the community. Now we connect the points of hope.” To Jones, hope means tying the need to save the planet from global warming to the need for economic development in Oakland. “Let’s make it into job opportunities for poor people and build a green economy strong enough to lift us out of poverty. That’s hope. We want to take people out of the prison cells, into solar cells.” Jones’s allies see him as a silver-tongued visionary, a lighting rod who can bridge movements with apparently differing agendas. Activist Julia Butterfly Hill, a longtime friend and political ally of Jones, told us at the event, “Van shows he cares and he’s human, and he puts himself out there on the line. That’s why you saw this coming together. This is the voice, this is the conversation that the planet is literally dying for, and I really mean sick and dying for.” The evening, a spirited celebration of hope and achievement, gave influential friends a chance to size up where the group has been and where it’s headed. As Harris of Mother Jones told us, “Van is a big thinker. He really engages people’s imaginations in terms of what could be. There’s one way, which is to fight against the system. Van’s way is to reimagine the system.” There to bless the event, Glover warmly heaped his own praise on Jones by comparing him to the Civil Rights Movement worker who is the organization’s namesake. “When I think of Ella Baker and what she stood for, Van carries on that work, and I think that’s vital. We envision ourselves through the women and men that set a certain standard. Van sets a certain standard.” SFBG www.ellabakercenter.org

Welcome to the nightmare

MEXICO CITY (Sept. 14th) – In an epiphany of how he might have to govern Mexico if, in fact, an aggrieved left opposition allows him to assume the presidency December 1st, right-winger Felipe Calderon had to be helicoptered to the bunker in the deep south of this conflictive capital, where the nation’s top electoral tribunal doing business as the TRIFE was to hand him the certificate attesting that he had, in the judges’ less-than-august opinions, won the hotly-contested July 2nd election from leftist Andres Manuel Lopez Obrador (AMLO.).

Upon emerging from the chopper, which had been accompanied by a military gunship, the stubby, balding Calderon, his eyes darting like the proverbial deer caught in the headlights, was quickly hustled into the TRIFE headquarters by the back door, a full 90 minutes before the actual ceremony was to commence, a subterfuge necessitated by the presence by thousands of AMLO’s enraged supporters, some of whom had already stripped naked.

Calderon’s witnesses – members of his campaign team and functionaries of the archly-rightist PAN party who had the misfortune to arrive by land — were greeted by clods of earth and screams of “Rateros!” (Thieves) and “Fraude!” (Fraud.) The ritual unfolded under a steady barrage of rotten eggs and tomatoes that AMLO’s people kept hurling at the TRIFE bunker, a kind of Aztec version of a U.S. missile silo, to express their unhappiness with the seven-judge panel that had neither heard nor seen any evil in the maladroit machinations of President Vicente Fox, the Federal Electoral Institute (IFE), and the PAN to steal the election from their candidate.

On September 5th, just hours before the constitutional deadline for confirming the next president of Mexico, the TRIFE had finally handed down its eagerly anticipated decision. In the learned justices’ unanimous judgment, outgoing president Vicente Fox’s unconstitutional intromission in the electoral campaign on behalf of Calderon had put the validity of the July 2nd balloting “at risk.”

Moreover, months of venomous anti-AMLO hit pieces designed by U.S. carpetbagger Dick Morris that labeled Lopez Obrador a DANGER to Mexico in big red letters “unquestionably” impacted the results and were illegally financed by big business councils that included such transnationals as Wal Mart and Halliburton, a patently criminal act.

In addition, the election was riddled with “arithmetic mistakes.” The TRIFE’s own recalculation of the actual vote count, effected by its much-maligned twin the IFE, demonstrated beyond a shadow of a doubt that Calderon had been credited with hundreds of thousands of votes that could not be substantiated by the number of ballots inside the ballot boxes. A partial recount of 9.7% of the 130,000 “casillas” (precincts) had turned up a total of 237,000 questionable votes that the TRIFE had chosen to annul, a quarter of those cast in the sample, and more than Calderon’s supposed margin which had been reduced to 233,000 out of a total 41.5 million cast.

Having duly noticed these egregious outrages, the seven judges concluded that they could not calibrate the impact of such organized criminal activity upon the final outcome and awarded the presidency to one Felipe de Jesus Calderon Hinojosa to the great delight and immediate congratulations of Mexico’s masters in Washington D.C.

Did the TRIFE go into the tank? Three of the justices are expected to be promoted to the Mexican Supreme Court when and if Felipe Calderon takes over the presidency. A fourth, Alejandro Luna Ramos, who will remain at the helm of the electoral tribunal, is a business partner of PAN topdog “El Jefe” Diego Fernandez de Cevallos – El Jefe won millions for the Ramos family from the Mexico City government before AMLO became mayor in a shady land deal involving the site of the Aztec football stadium. A Ramos sister sits on Mexico’s Supreme Court.

Lopez Obrador has suggested that the judges were willing recipients of “canonazos” (cannonades of pesos) to help them better contemplate the “validity” of the election. Porfirio Munoz Ledo, a hoary political chameleon who was Fox’s ambassador to the European Union, describes a post-electoral huddle at the home of Chief Supreme Court Justice Mariano Azuela, a Fox ally, where the Presidente warned the “TRIFitos” that should they declare the election null and avoid due to the overwhelming evidence of fraud, the Mexican economy would collapse and anarchy would reign in the streets. Although Munoz Ledo is an unsavory sort, his sources are usually impeccable.

Now that the TRIFE has legitimized the fraud, the IFE brain trust under the beady gaze of the chief architect of the July 2nd debacle, Luis Carlos Ugalde, is moving quickly to destroy the evidence. Following the modus operandi established after the stolen election of 1988 when the then-ruling PRI in connivance with the PAN ordered the ballots to be burnt by the military, the IFE has refused petitions from 16,000 suspicious subscribers to PROCESO magazine and a blue-ribbon commission of prominent members of the civil society to allow them to conduct a citizens recount of the ballots that are now, once again, under the protection of the military. Never! Ugalde and his mafia scoff. The ballots are “inviolable!” “The property of the people!”

But, on the other hand, the ballots are not “documents” open to public scrutiny as guaranteed by law, the IFE contends, and therefore are eminently “burnable” under current electoral stipulations. Ugalde’s ruling was described as “metaphysical” by National University law professor John Ackerman. According to the IFE’s hypothesis, the ballots were “documents” before they were marked by the voters but now they have been reduced to symbolic “expressions of the people’s will” and thus are candidates for the incinerator.

AMLO is sworn to preventing a repeat of the 1988 flimflam and his people are pleading with Azuela’s Supreme Court to stay the December date set for the burning – after all, an Ohio court just stepped in to save what ballots remain from Bush’s stealing of that state’s electoral votes in the smarmy 2004 presidential balloting. Not without a certain sense of déjà vu all over again, the final arbiter in this dispute may well be (who else but?) the TRIFE.

As illustrated by his armed airlift to the TRIFE silo, Felipe Calderon has a problem meeting the people he intends to govern over the next six years. In his first junket as president-elect, Fecal (as his detractors have dubbed him) took a sentimental journey to his native Morelia, the capital of the narco-ridden western state of Michoacan, where he was scheduled to lay a wreathe at the feet of that city’s namesake, Jose Maria Morelos y Pavon, a black defrocked priest who led the guerrilla war against the Spanish Crown several centuries before the 44 year-old Calderon first slithered from the darkness of his PANista mother’s womb.

Calderon’s family on all sides is a founding pillar of the PAN, an Opus Dei-like creature of Catholic bankers formed to denigrate Mexico’s beloved depression-era “Bolshevik” president Lazaro Cardenas, also a Michoacan native whose grandson, also Lazaro Cardenas, now besmirches that hallowed name as governor. Indeed, Calderon ‘s trip to Michoacan was designed to split Lopez Obrador’s three-party Coalition for the Good of All – young Cardenas is titularly a member of the PRD, AMLO’s home party, founded by his father Cuauhtemoc after he was swindled out of the presidency in 1988.

But Felipillo never made it to Morales’s feet (the good padre probably exhaled a sigh of relief). Hundreds of AMLO’s faithful tore down the barricades, tossed the usual rotten eggs and tomatoes at Calderon’s entourage, battled Cardenas’s state police and the elite Presidential military guard, and generally made the venue so unsafe that the wreath-laying had to be called off and the president-elect sped into a nearby locked-down convention center for a speech to a carefully-culled audience of “perfumados” (literally the perfumed ones.)

The draconian security measures at the convention center – sniffer dogs, metal detectors, pat-down searches – were not unwarranted. On the eve of Calderon’s confirmation, in Michoacan’s second city Uruapan, the capital of the state’s “hot lands” where drug cropping accounts for the whole economy, a ski-masked commando burst into a local dance hall, forced the patrons to lie face down on the dance floor under pain of being Swiss cheesed by the automatic weapons they were waving convincingly, and carefully removed five severed human heads from black plastic bags which they artfully arranged in the center of the “pista” (dance floor) with the accompanying message: “the family does not kill for money. It does not kill women. It does not kill innocents. Those who deserve to die, die. Justice is divine.”

This country has been visited by unspeakable acts of narco-terrorism in the months that Calderon has been blaspheming Lopez Obrador as “a DANGER to Mexico” (thanks Sasha for this observation). Such beheadings are now a regular feature of the cityscapes in Acapulco and Tijuana. Corpses are strewn in Baghdad-sized numbers each month in the rural outback of Sinaloa, Jalisco, Guerrero, Michoacan, and Chiapas. Judges are gunned down on their way to court at La Palma, Mexico’s maximum narco-lockup – published reports speak of a “psychosis of fear” spooking the nation’s judiciary. The brains of industry and the stock market are not immune from being splattered all over the street. Last week, the top official of a privatized customs agency part-owned by Fox’s financial secretary Francisco Gil, was cut down by professional hit men on a busy Mexico City street as the end-of-the-administration chickens begin to come home to roost. La Jornada, the left daily, has even gone on “suicide” watch – officials often blow their brains out or sever their veins with box cutters at such moments in the Mexican political dynamic.

The TRIFE’s confirmation of the stealing of the 2006 election has generated an avalanche of accolades for Felipe de Jesus – Bush and his crony ambassador Tony Garza were first in line to extend their congratulations all over again (they did so hours after the deeply flawed preliminary vote count came in July 2nd.) Spain’s Rodriguez Zapatero and his pals at REPSOL were right behind, looking to get in on the ground floor of the fire sale of privatization Calderon has pledged for PEMEX, the once-nationalized state petroleum enterprise. The U.S. State Department’s “democratic” answers to Hugo Chavez and Evo Morales, Alan Garcia and Oscar Arias, along with Salvador’s fawning Tony Saca chimed in. Improbably, so did Nestor Kirschner – can Fidel and Lula be far behind?

But to my ear, the most appropriate toast to Felipe Calderon ‘s confirmation as the next president of this dangerous neighbor nation was one that was not sounded (at least not yet.) In 1994, after Ernesto Zedillo had finally relieved the reviled Carlos Salinas at the wheel of state, the still missing-in-action Subcomandante Marcos scribbled salutations to the new prez that began, much as does this chronicle, “Welcome to the Nightmare.”

This past Sunday, Lopez Obrador’s weekly packed-as-usual revival meeting in the Zocalo transpired parallel to Felipe Calderon’s “victory” celebration, held appropriately enough in a bullring in an affluent district of the capital. AMLO’s numbers as always dwarfed his diminutive rival’s – the PAN reportedly padded out the crowd by requiring the compulsory attendance of Catholic school children and their parents. and the wealthy burghers in the south of the city were said to have obligated their servants to attend.

While the President-elect swore vengeance on his enemies across town, AMLO did not. As always, he let his furious flock call Fecal bad names but eschewed even mentioning his rival. Lopez Obrador had other plans. The seven week, seven mile encampment of his followers that so vex upper and middle class “capitolinos” would stay in place through Friday night, September 15th, the eve of Mexican Independence Day when AMLO intends to deliver the “Grito” of “Viva Mexico!” to the multitudes gathered in the great square, an honor reserved for the President of Mexico.

But rather than challenging the Mexican military, AMLO’s people will then dismantle their encampments and retreat from the Zocalo for 12 hours to allow the Generals and Admirals to conduct their traditional Independence Day parade. “The army belongs to the people, not the government – we have no argument with this institution,” AMLO explained seeking to mollify his militants who are reluctant to step back. “Many members of military families voted for us July 2nd. And besides the troops are so badly paid that they can’t even support their families.”

Once the military procession which always features tanks and jet fighter planes is done with – Vicente Fox will wave it on from a balcony of the National Palace and receive it at the newly refurbished (by the PRD Mexico City government) Angel of Independence – an expected million delegates to Lopez Obrador’s National Democratic Convention (CND) will retake the Zocalo and sit in session to install AMLO as the legitimate president of Mexico.

But Fox, who was prevented from delivering his State of the Union address to congress September 1st when Lopez Obrador’s senators and deputies stormed the tribune, is said to be obsessed with decrying his final Grito from the presidential balcony overlooking the Zocalo. Cornered between his hubris and personal ambition for a notch in history, and the huge angry crowd seething in the plaza below, the outgoing president could make a fatal mistake by turning the military and/or the military police on AMLO’s people to force them out of the Tiennemens-sized square that sits at the heart of Mexico’s political life, a move that indeed invokes both Tiennemens and Tlatelolco where in 1968 hundreds of striking students were massacred by the paranoid, anti-communist president Gustavo Diaz Ordaz, and a wound that has never closed here.

As Sub Marcos so eloquently waxes: “Welcome to the Nightmare.”

A lot has happened since Californians first rebelled against the canned food and Jell-O molds of the postwar industrialization era. The American food politics revolution is very much alive and well and thriving in the Bay Area, where the movement started. And California is still the food basket of the United States — it’s been the top grower in the country for more than half a century. The dialogue about sustainable growing practices and environmental impact is open, and the fight for more mindful production practices is still on.
We are home to around 100 farmers markets — including Alemany, which, at 63 years old, is the granddaddy of local markets. Alice Waters’s groundbreaking Chez Panisse restaurant celebrated 35 years of organic-minded Epicureanism this year. CSAs (Community Supported Agriculture farms) — started in the United States in the 1980s — are going strong. Local groups and organizations that continue to educate and activate the revolution around here include but certainly aren’t limited to San Francisco Food Systems, Food Not Bombs, Food First, and the Brentwood Agricultural Land Trust, which protects farmland against development. Blogs like the Eat Local Challenge, written by authors across the United States, and resource Web pages like those of the Center for Urban Education about Sustainable Agriculture, the organization that runs the Ferry Building farmers markets, offer a plethora of information about the local food politics movement.
And then there’s Larry Bain — restaurateur, activist, and founder and executive director of Nextcourse. He doesn’t just eat his politics, he feeds them to the Bay Area. Bain has a hand in a few of the finest and fanciest restaurants in town (Acme Chophouse, Jardinière), but his work through Nextcourse in San Francisco jails and schools and with the Golden Gate National Recreation Area narrows “the food divide” and shows how eating well doesn’t mean breaking the bank for artisanal olive oil. We talked to him about his organization and some of the major issues it’s taking on in the quest to bring mindful eating practices to the larger community.
SFBG What inspired you to found Nextcourse?
LARRY BAIN I’ve been a food activist since 1983, when I opened [Zola in San Francisco] with the intention of creating a new model for restaurants. Restaurants use more energy per square foot than any other retail operation, so the consumption of water, gas, electricity, and the generation of greenhouses gases tend to have a very deleterious impact on the environment. Then there’s the cleaning solutions used in restaurants. And the amount of garbage generated, the packing, and then of course the stuff we know and think first about restaurants, where food comes from, the fossil fuels used in the creation and transportation of food. Every year I owned a restaurant, I got more excited about the positive impact restaurants could have and about finding ways to influence other restaurateurs. Because nobody wakes up in the morning and says, “I want to be the cause of 17 trees being felled in the redwood forest.”
But I wasn’t big enough to take it all on. Every issue is far more complex than you’d think. Whether it’s a straightforward Atlantic salmon or a Chilean sea bass, there are layers of impact. Even eating local — what does that do to communities that depend on people in America buying their coffee beans or some other product? I wasn’t sure where to focus until I went to a seminar that was given at the UC Berkeley School of Journalism. All of my heroes were up on the stage: Vanda Nashiva, Orville Schell, Wendell Berry, Michael Pollan, Carlo Petrini. They were being eloquent and brilliant about the future of food and where we needed to be going, touching many things close to my heart.
As always happens at one of those gatherings, some smart-ass stood up and asked, “Excuse me, if we were going to make the transition from conventional to organic tomorrow, would we still be able to feed the world?” It’s the argument always thrown out by Archer Daniels Midland: “This is the only way to feed the world, through genetically modified crops and by conventional methods of distribution. All of this organic stuff is just pie in the sky.” And everybody, all of my heroes said, “Oh yes, organic farming is superproductive. You get a lot more nutrients out of every acre planted.”
Berry said, “We just don’t have enough farmers. If you went to the unemployment office and said, ‘OK, all you three guys over there, tomorrow you’ll be organic farmers’ — it requires tremendous wisdom and experience and we’ve lost that. Before we can talk about changing our food system, we have to be cognizant of the supply, and we don’t have the farmers and we don’t have farmland.” It was at this point that I thought, OK, this is going to be my passion, growing farmers.
I don’t know anything about agriculture. My area of expertise is the world of commerce, and I know what farmers need is a good path to sell their product. And because farmers cannot survive through Chez Panisse alone, they need a broader base of consumers that might be willing to buy things that aren’t as exotic as a $5 peach but greens or even fruit that is delicious but not beautiful.
SFBG Has cooking become some exoticized thing?
LB Elitist thing. People go to the Ferry Building not to buy their food but to accessorize their meals, and so what they’re going to eat is pretty standard stuff that they might get at Safeway or Whole Foods, and then they go to the Ferry Building to get this little bunch of herbs or this little piece of cheese that will make it a special dinner. And so how do you make shopping in farmers markets and cooking for your family more of a way of life rather than a lifestyle. When you’re living in a neighborhood filled with tension and stress and toxic materials, food becomes even more important to help you survive that, to help you keep a strong immune system. So Nextcourse started in the San Francisco county jail working with women who are moms, mostly, and who, once they get out, need to feed their family.
SFBG When did the cooking in jail program start?
LB I got a phone call from a teacher at a school in Emeryville to come and talk to students there about healthy eating. I took the chef and sous-chef from Acme Chophouse, and we cooked with the kids. A friend of mine said this would be a great program at juvie hall. And so I called juvie hall — it was a bureaucratic nightmare. The same friend said, “Well, I know someone who does work at the county jail. She’s a public defender.” So, I called her up and told her, “We want to do cooking classes in the jail. I’ve got these great chefs, and they know how to show people how to cook things that are delicious, nutritious, easy, cheap, fun. Can you help us out?” Within a week we met with the sheriff, who loved the idea.
In the classes, we talk about the importance of nutrition and the how-to. A lot of these women know that eating good food is important for their kids. They know this, and yet they think, “What can I do about this? I can’t afford to go to Whole Foods, and I can’t afford to eat at Chez Panisse.” So we show them where to shop, and every class has a menu. The teacher will shop the day before, both at Safeway or FoodCo or one of these cheap stores and at a farmers market — not at the Ferry Building but at Heart of the City or at Alemany or sometimes just at stores in the Tenderloin. And we line the ingredients up side-by-side and invariably the ingredients from the farmers market, aside from being more nutritious and delicious, are cheaper because we shop seasonally.
All of the cooking takes place with minimal equipment. In the jail we can’t use knives. Everything can be done — a salad, a main course, a vegetable — in 25 minutes, and for less than $5 a person. Cooking quickly is all about being organized. We teach them those skills as well.
SFBG How many women have gone through this program?
LB I think it’s about 750 now. One of the things that we’re moving forward with is finding a way to connect with the women after they leave. One of the new initiatives is working with a postrelease program where there’ll be a kitchen so we’ll be able to do the classes on an ongoing basis.
SFBG Something that a lot of people don’t know is that people who have a felony drug offense can’t get food stamps.
LB It was part of that whole clean up drugs thing. It’s changed slightly so that now if you have a minor drug offense, you can get food, but if you have a heavier felony offense, it’s still not possible. [Assemblymember] Mark Leno is working on fixing it.
SFBG Have you kept in touch with the women from the program?
LB Yeah. We have one woman who found us because we also offer the courses to women who provide day care. She told us, “When I was in jail, I was thinking this was all bullshit. I can’t do that. It’s going to be too expensive. It’s just you white people blowing smoke up our ass. But I got out and now I’m going to the market every week and my kids love it.”
SFBG You’re also coordinating food service for the Golden Gate National Recreation Area?
LB Yes, coordinating purchasing so the prices are better, but also coordinating so some people can get products that there hasn’t been enough demand for. The great thing about McDonald’s is that it represents this huge buying power, and if McDonald’s says, “We want an alternative to Styrofoam,” people say, “OK, we’ll do that.” So when 17 food services here say, “We really want cornstarch knives or sugar-based packaging material” … companies will see this opportunity and figure it out.
I started talking to the people in the national park for two reasons. One is that the park feeds a lot of people. Golden Gate Park is 75,000 acres, the largest urban park in the country, and feeds 17 million people a year, whether they’re dining at Greens, which is a park partner, or the Cliff House or some little café. The park also sits on a tremendous amount of good agricultural land, some of which is being used up at Point Reyes National Park. Cowgirl Creamery, Strauss Dairy, Hog Island Oyster, Sun Farm — all those are on park land. We want the park to become not only a purchaser of good sustainable, healthy food but also a producer.
SFBG One of the reasons why Nextcourse is interesting is that it addresses the “food divide,” actually doing outreach into the community that is not going to show up at the Ferry Plaza Farmers Market. What do you think needs to be done? It feels like the gap is getting wider rather than narrowing.
LB That just represents what’s happening in our society. Truly, you can’t change the food system without looking at every other aspect of the economic system. You’ve heard it before, but there’s all these wonderful catchphrases like “the high cost of cheap food.” People shouldn’t be asking why this beautiful piece of fruit is so expensive, they should be asking why this other piece of fruit is so cheap. And the reason it’s cheap is because of the way our economy is structured, with lobbies, subsidies, and oil companies having such a strong vested interest. The real problem with food costing “X amount” is that we can’t survive just on food. We need housing, we need education, we need health care. The government is no longer in the public service business: they’ve privatized all of those things, and they’re driven by profit. People can’t afford more expensive food because they’re spending so much on rent, health care, and more expensive schools.
We’ve created a society that’s increasingly divided the rich and the poor. Food is just symbolic. If we want a just society, this is just one aspect — don’t stop at food, but see food as the beginning, a way to engage in a better world.
SFBG What about the conceptual problem? It’s fine to repeat the mantra that cheap food is more expensive, but when it’s not immediately visible …
LB We’re encouraged to not see beyond our own noses. It’s not in the interest of economy for us to think of long-term effects, to see the net. We just see “cheap.” This is the money I have in my pocket at the moment. I’ll worry about the hospital when I have to go to a hospital, and in fact, it’s best not to think about that. So in order for things to change, food people need to see that while they need to collaborate among the food community, they also need to collaborate among the social justice community as a whole. The food community has to see that people struggling for immigration rights, workers’ rights, health care rights are their natural friends.
SFBG What are some organizations around the Bay Area that are doing good work?
LB On a really grassroots level, I think la Cocina is fantastic — an industrial kitchen facility that brings in mostly Latina women with the hope that they’ll be able to have their own kitchen or restaurant someday. The Columbia Foundation, particularly through their Roots of Change program. Something new to the Bay Area is the Community Alliance for Family Farmers that is trying to bridge the gap between farms and urban centers.
SFBG What are the top issues facing the Bay Area — in terms of food and our ecology — in the next decade?
LB The offshoring of our food production. It’s going to happen unless we start yelling and screaming, because it is so much cheaper to grow and produce food in developing nations. A lot of these agribusiness companies want to get out of the US. They want to be someplace where there are no labor laws, there are no environmental restrictions. That’s what keeps me up at night. I wake up in the middle of the night screaming, “They’re offshoring our food production.”
Environmentally, water is the biggest issue that we’re facing. What’s happening is that farmers are saying, ‘I could sell my water for much more money than I could ever make growing food.’ Because all of our communities, particularly those built in deserts, are so desperate for water that they will pay anything for it. So as water becomes more politically contentious and expensive, anybody doing agriculture will go someplace where there isn’t necessarily more water but they can get it for free or get it illegally. After William Randolph Hearst flunked out of Harvard in the 1880s, he pursued a new career path, asking his wealthy father for only one thing: the San Francisco Examiner.
Young William didn’t stop with the Examiner — over his lifetime, he accumulated dozens of newspapers nationwide. Eventually, one in five Americans regularly read a Hearst paper.
That seems like a lot of power and influence, and it was. But it’s nothing compared to what the heirs to Hearst’s media mogul mantle are doing today.
In fact, the Hearst Corp. is working with another acquisitive newspaper magnate, William Dean Singleton, to lock up the entire Bay Area daily newspaper market. If the project succeeds, one of the most sophisticated, politically active regions in the nation may have exactly one daily news voice.
That worries Clint Reilly.
The political consultant turned real estate investor has sued the Hearst Corp., owner of the San Francisco Chronicle, for the second time in a decade to stop a partnership he fears will eliminate the variety of voices among newspapers in the Bay Area.
It’s an amazing story, full of politics, big money, secretive arrangements, and juicy executive bonuses. What’s at stake? Control over one of the most lucrative businesses in Northern California.
But for the most part, you aren’t reading about it in the daily papers — which means you aren’t seeing it on TV or hearing about it on the radio.
In fact, the blackout of the inside details of the Singleton deal and Reilly’s effort to stop it is one of the greatest local censored stories of the year — and the way the press has failed to cover it demonstrates exactly what’s wrong with monopoly ownership of the major news media.
The story began in the spring when one of the nation’s more respected newspaper chains, Knight Ridder, was forced to put itself up for sale after Bruce Sherman, a prominent shareholder, decided that the company’s relatively healthy profit margins (and dozens of Pulitzers) were simply not enough.
It’s the nature of publicly traded companies to be vulnerable to shareholder insurrections, unless they have multiple classes of stock. Knight Ridder didn’t, and although its former chief executive, P. Anthony Ridder, later said he regretted the sale, Knight Ridder went on the block.
The Sacramento-based McClatchy chain bought the much bigger Knight Ridder but needed to sell some of the papers to make the deal work.
In the Bay Area, Knight Ridder’s two prime properties, the San Jose Mercury News and the Contra Costa Times, were bought by MediaNews Group, the Denver-based conglomerate run by Singleton. That was a problem from the start: Singleton already owned the Oakland Tribune, the Marin Independent Journal, the San Mateo County Times, and a series of smaller local papers on both sides of the bay. The two former Knight Ridder papers would give him a near-monopoly on daily newspaper ownership in the region; in fact, there was only one daily in the area that would be in a position to compete with Singleton. That was the San Francisco Chronicle.
But in one of the strangest deals in newspaper history, Hearst — the erstwhile competitor — joined in the action, buying two of the McClatchy papers (the Monterey Herald and the St. Paul Pioneer Dispatch) and then immediately turning them over to Singleton, in exchange for some stock in MediaNews operations outside of California.
When news of the transactions first broke, MediaNews publications and the Hearst’s Chron covered it extensively, more than once putting the billion-dollar partnership on the front pages. (The transactions also involve a company formed by MediaNews and two of its other competitors, the Stephens Group and Gannett Co., called the California Newspapers Partnership.)
Since then, however, coverage has been overshadowed by JonBenet Ramsey and local crime news. The real story of what happened between Hearst and Singleton and how it would devastate local media competition never made the papers.
If this had been a deal involving any other local big business that had a huge impact on the local economy and details as fishy as this, a competitive paper would have been all over it. And yet, even the Chron was largely silent.
In fact, when Attorney General Bill Lockyer decided not to take any action to block the deal, the Chron relegated the news to a five-paragraph Reuters wire story out of New York, buried in the briefs in the business section. The original Reuters story was cut; the news of Reilly’s suit and his allegations didn’t make it into the Chron version.
At times, the new Singleton papers have treated the story with upbeat glee: in early August, the Merc proclaimed in a headline that the area’s “New media king is having fun.”
The story noted: “MediaNews is privately held, a step removed from the Wall Street pressure that forced the Mercury News’ previous owner, Knight Ridder, to put itself up for sale…. Singleton is its leader, and by all accounts, a man who lives, breathes and loves newspapers.”
Longtime media critic and former UC Berkeley journalism school dean Ben Bagdikian, author of The Media Monopoly, told the Guardian that most of the coverage so far has focused on the business side of the transactions.
“The coverage I’ve seen has simply described the devices they used to divide the McClatchy chain and did not describe how cleverly it was designed to avoid an antitrust action,” Bagdikian said.
Here’s some of what the daily papers have ignored:
The Hearst deal was certainly good for MediaNews, because on the same day the agreement was signed, top executives at the company were awarded $1.88 million in bonuses. MediaNews president Joseph Lodovic earned the chief bonus of $1 million, while the president of MediaNews Group Interactive, Eric Grilly, received over $100,000 in bonuses on top of a $1.25 million severance package for retirement. The figures were disclosed in the company’s most recent Securities and Exchange Commission filing.
Hearst has insisted repeatedly that its investment in MediaNews involves only tracking stock, meaning its up-and-down value rests solely on the performance of MediaNews businesses outside of California. Such a structure may help the two companies comply with antitrust rules — for now.
But in a little-noticed footnote included in a July memo filed by Hearst in response to Reilly’s lawsuit, the company revealed that its tracking stock could still be converted to MediaNews common stock in the future — meaning it would then have a stake in the entire company, including its Bay Area holdings. “The tracking stock will be convertible into ordinary MNG common stock, but that will require a separate, future transaction and its own Hart-Scott-Rodino review,” the July 25 document states.
In other words, public records — information freely available to the 17-odd business reporters at the Chronicle — show that Hearst’s fundamental presentation of the deal is inaccurate. Hearst is not just a peripheral player in this deal; the company is a direct partner with Singleton and thus has no economic incentive whatsoever to compete with the Denver billionaire.
And that means there will be no real news competition either.Reilly has been in politics most of his adult life, and he knows what happens when one entity controls the news media: perspectives and candidates that aren’t in favor with the daily papers don’t get fair coverage.
Newspapers, he told us recently, are charged with checking the tyranny of government; without competition they will fail to check the tyranny of themselves.
“The combination intended to be formed by these defendants constitutes nothing less than the formation of a newspaper trust covering the Greater San Francisco Bay Area,” Reilly’s suit states, “implemented through anticompetitive acquisitions of competing newspapers, horizontal divisions of markets and customers, and agreements not to compete, whether expressed or implied.”
A federal judge recently tossed Reilly’s request for a temporary restraining order against the Hearst transaction. But Reilly’s overall lawsuit, designed to stop Hearst’s $300 million investment in MediaNews, will still wind its way through the courts, and Judge Susan Illston signaled in her last order that she would “seriously consider” forcing MediaNews to give up some of its assets if the court finds the company’s transactions to be anticompetitive.
There are clear grounds to do that. In fact, as Reilly’s attorney, Joe Alioto, points out in his legal filings, the monopolists have made the argument themselves. When Reilly sued to block the Examiner-Chronicle deal in 2000, Hearst, which wanted to buy the Chron and shutter the Examiner, argued that closing the Examiner would have no competitive impact — since all the other competing Bay Area papers provided the reader and advertiser with a choice. Now the lawyers are arguing just the opposite — that the Chron and the outlying papers never competed in the first place.
Hearst will more than likely argue in court that since its newspapers face unprecedented competition from online content, there’s technically no such thing as a one-newspaper town. The world is globally connected now, this thinking goes, and the Chron and MediaNews both face competition from popular blogs such as Daily Kos and Valleywag on the West Coast and Gawker and Wonkette on the East Coast.
But that ignores a media reality: for all the power and influence of bloggers and online outlets, daily newspapers still have the ability to set the news agenda for a region. Among other things, local TV news and radio stations regularly take their cues from the daily papers — meaning that a story the dailies ignore or mangle never gets a real chance.
MediaNews argues in its most recent memo to Judge Illston that “any potential anticompetitive effect of the transactions against which the Complaint is directed is greatly offset and outweighed by the efficiencies that will result from those transactions.”
“Efficiencies” isn’t actually defined, but if the past is any indication, jobs could be the first place MediaNews looks to “efficiently” save money for its investors — at the cost of performing the traditional role of a newspaper to monitor government.
Reporting — real reporting — is expensive. It requires experienced journalists, and a good paper should give them the time and resources not only to watch day-to-day events but also to dig deep, below the headlines.
That’s not the monopoly media style.
Speaking in general terms, Jon Marshall, who runs the blog Newsgems and teaches at Northwestern University’s Medill School of Journalism, wrote us in an e-mail that newspapers have to be willing to invest in innovation now, while there’s still time.
“If newspapers really want to win back readers, they’ll need to start offering more outstanding feature stories that really dig deep and have a big impact on their communities,” Marshall wrote. “Readers need a reason to turn to newspapers rather than all the other content that’s now available through the Web. Newspapers will have a hard time creating these outstanding stories on a consistent basis if they keep paying their current skimpy entry-level salaries.”
The pattern Singleton is known to follow isn’t unique. A recent survey conducted by journalism students at Arizona State University revealed that the nation’s largest newspapers are giving reduced resources to investigative and enterprise reporting as media companies trim budgets to maintain or increase profits. More than 60 percent of the papers surveyed, the report stated, don’t have investigative or projects teams.
Brant Houston, executive director of Investigative Reporters and Editors, told us that while teams of reporters dedicated exclusively to investigations may be disappearing, many papers are willing to pull staffers away from their regularly assigned beats to make sure that big stories are thoroughly covered. But, he said, Wall Street’s haste to make money could backfire if readers head elsewhere in search of more exclusive content.
“I think everything is in flux right now,” Houston said. “Everyone’s trying to figure out what the next newsroom looks like.”
Luther Jackson, an executive officer of the San Jose Newspaper Guild, which represents staffers at the Merc, said it’s too early to determine the impact of MediaNews on the paper. The union just recently began new contract negotiations with the company, while the previous agreement, which expired in June, remains in place. Jackson said he didn’t believe the Merc’s Silicon Valley readers would tolerate any dramatic dip in quality coverage.
“We have a problem with the idea that you can cut your way to excellence,” Jackson said.
Just six years ago, after Reilly sued Hearst the first time to stop its purchase of the Chronicle and subsequent attempt to shut down the Examiner, trial testimony revealed that the Examiner had, in fact, abused its editorial power to advance its business interests. Examiner Publisher Tim White admitted in open court that he had traded favorable editorial coverage to then-mayor Willie Brown in exchange for his support of the Chronicle purchase.
Reilly lost that one — but for now this case is moving forward. The suit could be the last legal stand for people who still think it’s wrong for one person to dominate the news that an entire region of the country depends on — and at the very least will force the story of what really happened out into the open. Empowerment or censorship?

Amnesty International last month launched a campaign demanding that online search companies stop complying with Internet censorship in China. The campaign targets Bay Area search engines Google and Yahoo!, along with Microsoft. With 105 million Chinese citizens plugging into cyberspace, can global search companies resist China’s technological marketplace? Should citizens lack global, albeit incomplete, access to the Internet because of the government’s repression of some information?
Amnesty’s Irrepressible campaign targets corporate accountability, a departure from its usual focus on human rights violations by governments. Irrepressible.info features an online pledge calling on governments and companies to respect the Internet as a source for information dissemination. The pledge will be presented this fall at a United Nations conference on the future of the Internet. The campaign also advocates to make censored material available for publication on personal blogs and Web sites.
The goal of Irrepressible, Amnesty’s corporate action network coordinator Tony Cruz told the Guardian, “is to put pressure on these companies to end the use of Internet censorship, which infringes on the basic human rights of the Chinese people.”
Google launched a censored Chinese search engine called Google.cn. Microsoft shut down a blog at the government’s request. Yahoo! provided Chinese authorities the private e-mail information of its users, resulting in prison sentences for two journalists. Irrepressible.info calls for the release of one, Shi Tao, who received a 10-year sentence for sending information on the anniversary of the Tiananmen Square massacre in an e-mail. Amnesty has not let these matters go quietly and has taken its concerns to the heart of the companies: their annual shareholder meetings.
On May 25, Cruz addressed Yahoo! CEO Terry Semel and founder Jerry Yang, asking if the company would “call on the Chinese government to release Shi Tao, Li Zhi, and other innocent victims of China’s online repression.” Yahoo! execs never directly answered Cruz’s request. When asked about the issue recently by the Guardian, a Yahoo! spokesperson issued a statement saying the company is “pursuing a number of initiatives” to address the concerns.
But Yahoo! no longer operates in China, at least not directly. Last year Yahoo! sold its China subsidiary to Chinese e-commerce specialist Alibaba, although Yahoo! holds a seat on its board. It is no longer necessary for Yahoo! to censor prohibited words, as searches on international search engines are filtered on China’s end. That is Alibaba’s responsibility.
But for Google.cn, censoring is up to Google. At Google’s shareholder meeting in early May, Cruz addressed cofounders Sergey Brin and Larry Page, asking if Google planned on assuring its customers that the company will not favor profit over human rights. The cofounders, in response, pointed their fingers at Yahoo! Brin explained that Google.com is still available uncensored in China and is used less than Google.cn. But Google spokespeople have publicized their position on China since the start of Google.cn, including the issues Amnesty targets in its campaign.
Before Google launched its Chinese search engine, Google.com was available worldwide, including in China. But the program had to travel through eight Chinese Internet Service Providers, or ISPs, which control how much information a user can access. Google’s search engine slowed until service was all but stalled. Access to searches for “Tibet,” “Falun Gong,” and “Tiananmen Square” were denied.
This created two problems for Google: users were turning to faster China-based search engines, and results were filtered without disclosure to its users. Google faced an issue that touched on its most fundamental commitment — satisfying the interests of users by expanding access to information. After lengthy consideration, Google launched Google.cn, a China-based search engine that discloses to its users when information is censored.
How responsible is it for IT companies to curtail information dissemination for the sake of profit? In testimony before the Committee on International Relations, Google’s vice president of global communications and public affairs, Elliot Schrage, explained that Google was one of the last Internet search giants to enter the Chinese market. Also, he noted that many countries censor material on the Internet, including the United States, which once banned child pornography sites in Pennsylvania. France filters neo-Nazi content from its search engines. Germany blocks access to foreign-based hate sites. Iran filters political sites that are critical of the government. Why focus on China?
“Because,” Cruz says, “China is profitable. The Internet in the Asia Pacific Rim will be worth hundreds of billions of dollars in the next five to ten years. IT companies know it, and they have been quick to acquiesce to the needs of the Chinese government in order to grab a piece of the pie.”
Amnesty International has not overlooked the fact that Google has struggled with its principles over this decision. And it recognizes that of Google, Yahoo!, and Microsoft, only Google has met Amnesty’s call for transparency in filtered searches. Wouldn’t Google be doing more of a disservice to the Chinese by not providing a Chinese-based search engine? According to Cruz, no.
“This type of censorship has never led to anything productive,” Cruz says. “It has always been used to oppress the views of those who challenged the status quo. When these companies say ‘a censored search engine is better than none at all,’ I believe this is a slap in the face to the Chinese men and women who fight this repressive government.”
While Amnesty International continues to draw attention to China’s government, China is very much a part of the global economy. With China in the World Trade Organization, can companies like Google resist joining the rest of the global community? Google has called on the US government to treat censorship as a barrier to trade, but censorship has not stopped them from entering China.
The US government opposes the United Nations business norms declaration, which decrees that companies are obligated under international law to protect human rights. The US delegation states that human rights abuses are the result of national governments, not private enterprises. With their own country openly questioning the role of companies in overseas human rights abuses, is it fair to call these companies complicit for following the rules of trade? SFBG

SF Opera under the glass

There is no lack of world-class talent in the upcoming fall season, but as far as the portentous tenants in the Civic Center are concerned, the new season’s repertoire stands out as an exercise in artistic tepidness. Perhaps still traumatized by the Bush economy’s brutal impact upon the arts, the San Francisco Opera and Symphony and other big Bay Area arts presenters are taking few chances. Projects with even the subtlest hints of experimentation this season — such as the SF Symphony’s multimedia production of Charlie Chaplin’s City Lights — are being served to the public in carefully marketed packages, brandishing favorite performers with tried-and-true creative teams that have been thoroughly tested over the years.
So as the curtains go up next week, the best performance to watch may well be the one that is taking place offstage: David Gockley, the SF Opera’s new general director, heads his first full season as the top choice for the job. With the company’s somewhat contentious regime change (Pamela Rosenberg vacated the lead post last season), Gockley knows that his every move is being scrutinized by the opera world.
Rosenberg was the only woman leading a major American opera company during her tenure at the SF Opera, boldly introducing on the War Memorial stage the US premieres of major contemporary works such as Olivier Messiaen’s massive St. Francis of Assisi, György Ligeti’s Le Grand Macabre, and the world premiere of John Adams’s Dr. Atomic. Even while facing the funding challenges of a deflated economy, Rosenberg chose to focus the company’s resources on creating the daring, provocative concept-driven productions that are common in Europe. Instead of squandering her production budgets on expensive star singers, Rosenberg brought a fertile artistic sensibility to the company that was wholly fresh and exciting.
Yet the lack of recognizable marquee names combined with the high level of abstraction in her productions displeased the opera’s more conservative, traditional constituencies. Typically, the anti-Rosenberg camp was made up of Metropolitan Opera–jealous patrons and the shrill, mercilessly critical traditionalists who prefer museumlike productions — the kind of stagings populated with ornate period costuming and opulent sets that are often mere vanity vehicles to glorify star singers. So, faced with the criticism of diva-starved patrons and the prospect of having to devote an enormous portion of her time on the job to fundraising, Rosenberg chose not to renew her five-year contract with the SF Opera when it expired.
Attempting to find a less polarizing replacement, the SF Opera’s search committee came up with Gockley, the highly respected former general director of Houston Grand Opera. Chief among Gockley’s strengths is the rapport he has with top talent in the field, paired with a proven ability to entice them into high-profile collaborations.
“I would like to pursue a policy of bringing more of the most prominent stars back to San Francisco, similar to the kind that the public enjoyed during the [Kurt Herbert] Adler and [Terence] McEwen years,” Gockley said in a phone interview last week. “People expect that of a great international company — to provide the big personalities and the most glamorous performers.”
Yes, the divas are back, though certainly not in the abundance suggested by the opera’s tacky marketing campaign launched during the summer season. But what could be the rationale behind the extreme conservatism of SF Opera’s 2006–07 season, in which the most modern entry is Richard Strauss’s Der Rosenkavalier (1911) and the production rosters are populated by stalwart traditionalists such as Michael Yeargan, Thierry Bosquet, and John Conklin? “This year is not mine,” Gockley pointed out, indicating that it was planned by his predecessor before his arrival.
Not unlike Rosenberg, in Houston, Gockley was also known as an innovator and risk taker. In the heart of Bush country, he ushered in Adams’s Nixon in China, a momentous premiere in the history of American opera. A few years later, his controversial commission of Stewart Wallace and Michael Korie’s Harvey Milk was picketed by the religious right.
So what does he have in store for those who actually like more daring theatrical statements?
“Nothing this year,” he said dryly. “But we have already announced a world premiere by Philip Glass [an opera based on the Civil War battle of Appomattox] for next season and will announce the new season in January. Much as I did in Houston, we will have a blend of some core and peripheral repertory work, new works, and premieres — done with great singers and great musical and theatrical values.”
In all fairness, Gockley has the difficult job of being all things to all people during this transitional phase. Of course, this is only the beginning, and before he has the buy-in from all the locals, this former Texan will still have much to prove. SFBG

In the rarest of opportunities, the brilliant British composer and pianist Thomas Ades pays a visit to San Francisco to play a recital of his music at Herbst Theatre. Ades created a sensation when, as a fresh-faced 23-year-old composer, he premiered his opera Powder Her Face (containing the now-infamous fellatio scene) in Britain in 1995. EDITORIAL Those with power rarely use it to help the powerless: workers, foreigners, or the planet. That’s why we’re fascinated by the green noises that we’re starting to hear from übercorporation Wal-Mart and with its decision to hire our hometown environmental heavy hitter Adam Werbach, a move that reporter Amanda Witherell explores in this week’s cover story (see “An Unbelievable Truth,” page 15).
We’re skeptical of Wal-Mart’s motives and commitment to putting the planet before profits, so we truly hope that Werbach hasn’t been co-opted into a greenwashing effort. But because of the positive potential in this arrangement, we’re willing to trust Werbach’s judgment. In turn, we urge him to remember his roots and expect him to document his experience inside Wal-Mart and blow the whistle if Wal-Mart isn’t honoring its promises.
Let’s take a minute to look at the timing and potential of this. Wal-Mart is on the ropes even though it’s the undisputed heavyweight champion of the world. The activists and communities that oppose it are banding together like never before. And they’re getting bolder in that opposition, such as when the city of Hercules earlier this year used eminent domain to seize land from Wal-Mart rather than allow a store in its community.
Wal-Mart has also lost some political clout. First it lost its most supportive Democrat when fellow Arkansan Bill Clinton left the White House. The Republican Party it sponsors is also likely to lose ground in the midterm elections, just as the country’s trade deficit hits record levels.
People are also waking up to the fact that Wal-Mart’s poverty-level wages and lack of good health insurance end up being subsidized by taxpayers. And there very well could bubble up a backlash against the kinds of obscene wealth-hording being pushed by Wal-Mart’s Walton family and others, as reporter George Schulz also details in this issue (see “Shackling the Tax Man,” page 11).
Finally, consider two high-profile media moments from this summer that put more pressure on Wal-Mart. The Al Gore film An Inconvenient Truth has succeeded in placing global warming near the top of people’s concerns. This pressing environmental problem is made much worse by Wal-Mart’s practice of importing and distributing goods all over the planet.
The other was a widely circulated essay in the July issue of Harper’s Magazine, “Breaking the Chain,” which made a strong case for the federal government bringing an antitrust action against Wal-Mart and smashing the chain to pieces. The article focused not on the widely discussed environmental and labor arguments, but on how Wal-Mart’s market power and the way it wields it hurts the economy and other businesses because it can dictate terms to all of its suppliers, a concept known as monopsony power.
So we all have good reason to believe that Wal-Mart executives and their newfound concerns for the people and the planet aren’t just motivated by altruism. And this corporation has a long way to go before anyone should believe its executives intend to transform it into a force for good. We simply don’t trust Wal-Mart and don’t think anyone else should either.
Ah, but what if? That’s the question that will cause us to hold our fire for now and watch to see whether Wal-Mart’s actions follow its rhetoric. Given Wal-Mart’s monopsony power over suppliers and near monopoly power over consumers, this corporation has the power to force substantial changes in the wasteful and overly consumptive habits of the average American. The potential here is phenomenal.
Is Werbach the guy to help them realize that potential? Maybe. He’s been an inspiring and effective crusader for economic and social justice for most of his life, which is why we were thrilled when Sup. Chris Daly snuck him onto the San Francisco Public Utilities Commission.
But in that role, he hasn’t been the bold visionary that we’d hoped for. Community Choice Aggregation, that baby step toward public power, moved way too slowly and didn’t go far enough, largely because Werbach failed to lead. And the movement for real public power has long been stalled, even on a commission that should be focused on kicking Pacific Gas and Electric out of San Francisco, although we’re pleased by the latest sign of life: the SFPUC is trying to offer public power from renewable sources on the former Hunters Point Naval Shipyard property (see “Public Power Play,” page 10).
Werbach needs to be a forceful and uncompromising advocate for Wal-Mart to radically change its business model, and if he hits serious roadblocks, he must be willing to quit and talk about his experience with the Guardian or another publication, no matter what the personal cost. SFBG

Shackling the tax man

Late last month, David Cay Johnston of the New York Times managed to get a story about IRS layoffs picked up by the San Francisco Chronicle and placed on page three. That’s no small challenge, even in one of the most politically charged cities in the nation. It was not a sexy story, neither to liberals nor to conservatives.
But the story’s timing was impeccable.
Johnston reported that the IRS was poised to lay off 157 of its 345 estate- and gift-tax attorneys working at agency offices throughout the country — a division of investigators that generates more revenue for the federal treasury by catching tax cheats than any other group of auditors, about $2,200 for every hour that they work.
Dismantling the estate tax has been among the most aggressive crusades taken up by the Republican Party and its friendliest contributors for at least the last decade. Leaked to the Times by IRS whistle-blowers, the story about the layoffs surfaced just days before Congress rejected for the fifth time since 2001 an attempt by fiscal conservatives to get rid of the estate tax. The legislation failed despite Republican control of both the House and Senate. Even tempting Democrats with the first federal minimum-wage hike in 10 years couldn’t do the trick.
So how could defending the estate tax and the right of the IRS to collect it survive two branches of the federal government dominated by a political party that holds most taxation in contempt? It’s because families awash in seemingly infinite wealth are the only ones who get hit by the tax — despite false claims made by the GOP that the estate tax kills small businesses.
California filed more estate-tax returns in 2001 than any other state in the country by a margin of thousands. The only state that came close was Florida, and California still filed around 6,000 more returns, according to the most recent IRS numbers.
In other words, the Golden State is filthy, stinking rich and more vulnerable to the estate tax than other states. GOP party leaders in Washington insist the issue will return in the form of a new bill, and the IRS is behaving as if the estate tax has already disappeared. If it does, the richest families in the United States — highly concentrated in California and the Bay Area — stand to collectively save billions of dollars.
The Bay Area contains within its sloping hills and mammoth upstart tech firms higher income levels and more general wealth than almost anywhere else in the country. In fact, the San Francisco metropolitan area is the fourth wealthiest in the nation, according to Merrill Lynch, and two tiny cities between here and Mountain View, where Google is based, have the highest per capita median income in the United States. Those two cities, Atherton and Hillsborough, have a combined population of about 17,000, and while many of these techie tycoons are young, the day will come when they die and pass millions of dollars on to their descendants. Will there be enough tax investigators available to audit those estates? Will there even be an estate tax?
Following Johnston’s revelations, a Times editorial suggested the layoffs were a politically motivated attempt by the Bush White House to circumvent the legislative process. What it can’t accomplish through Congress it can do by handcuffing the tax police.
“This is an election year issue,” said Jay Adkisson, a private sector tax lawyer from Laguna Niguel who documents egregious cases of fraud on his Web site, Quatloos! “They’re trying to appease Republican voters who were angry over the failure of Congress to do something about the estate tax.”
The story of the IRS layoffs didn’t just catch the attention of readers. Congress responded too. Twenty-three lawmakers — including, somewhat predictably, Democrat Tom Lantos of California’s 12th District — immediately fired off a letter to Bush-appointed IRS commissioner Mark Everson demanding to know if the agency could now effectively investigate estate-tax avoiders.
None but the most obscenely wealthy Americans pay even a dime in taxes when they earn an inheritance upon a death in the family. Estates aren’t hit with taxes until they reach a value of $2 million, or $4 million for a married couple. Only estates exceeding those amounts are assessed any tax, according to the Center on Budget and Policy Priorities (CBPP).
And if the family hires a savvy tax attorney or estate planner, those nontaxable values could easily rise to $10 million, according to Adkisson.
A research director at the Brookings Institution named Diane Lim Rogers opined in the Chronicle last May that because of current exemptions, about one half of one percent of dead people will actually be followed to the grave by the tax man. Besides, it’s the beneficiaries of an inheritance who pay. Despite grand claims made by Republicans that the beneficiaries of an estate will be paying half of what they’re handed in taxes, even the estates eligible for taxation see on average a 20 percent rate, according to the CBPP, which relied on the IRS for its statistics. For those who do pay estate taxes, deep discounts are available through charitable donations.
“The argument made about lots of people being ‘burdened’ by estate taxes is that they go through lots of convoluted tax-planning strategies in order to avoid the estate tax, so even if they don’t end up paying any estate tax, they are still adversely affected [burdened] by the existence of the tax,” Rogers wrote in an e-mail to the Guardian.
But even considering the cost of estate planning, Rogers said, no one would rationally spend more avoiding taxes than they would actually paying them.
Keith Schiller, a respected private sector tax attorney based in Orinda, earns princely sums teaching millionaires how to take advantage of loopholes in the federal tax code. He’s not opposed to the estate tax on principle; he just wants to simplify the way his clients pay their dues.
“I do believe the estate tax serves a social function of breaking down generational dynastic wealth,” he said in a phone interview.
Schiller said the IRS is conducting nowhere near the estate-tax audits it once did and that may be the only justification for laying off auditors. Still, the knowledge required by agency investigators to analyze and understand complex estate-tax avoidance schemes is immense. About 50 estate- and gift-tax attorneys based in Southern California and the Bay Area exclusively handle returns filed for the IRS from inside the state.
David Dean, president of the San Jose–based National Treasury Employees Union (NTEU) Local 238, said it’s not clear which offices will have layoffs. All 350 estate-tax auditors are being offered buyout deals that include their pensions plus up to $25,000, or $13,000 after taxes.
Dean and the NTEU, which represents the auditors and opposes the layoffs, insist the IRS isn’t entirely sure how much money is hidden from the agency each year through either elaborate trusts or simple refusals to file. It’s known as the “tax gap,” and three days after Johnston’s story appeared, the inspector general of the IRS, J. Russell George, told Congress that the agency’s estimated figures for delinquent estate taxes hadn’t been updated in years. His report described a self-fulfilling prophecy in which the IRS expressed no desire to update the figures because “consideration is being given to eliminating or reducing the number of people required to pay estate taxes.” The last estimate was about $8 billion, but that figure is for the most part unreliable, he testified.
But the law still exists, regardless of whether an anti–estate tax agenda eventually succeeds in Congress.
“If a law is on the books, you still have to close down on the cheaters,” said JJ MacNab, an estate planner who spent 18 years in the Bay Area working for tech clients. “If you don’t enforce a law on the books, no one’s going to have faith in the system.”
MacNab now lives in Washington and as a hobby assists people who buy into tax-avoidance schemes that turn out to be illegal. She said these days, it’s low-income earners who are likelier to be audited, a conclusion Johnston also came to in his 2003 best-seller, Perfectly Legal: The Covert Campaign to Rig Our Tax System to Benefit the Super Rich — and Cheat Everybody Else. The book shows how the recent layoffs are a small part of a larger movement to weaken the IRS’s investigative capabilities.
And that movement begins with those who can afford to fund it. Who are they? Well, they’re not your average farmer.
Consistently during the debate over estate taxes, the GOP has co-opted the populist language that once dominated America’s agrarian communities by claiming that the “death tax” bleeds poor farming families dry. It’s a spectacular rhetorical tool, but it’s an ugly distortion.
In fact, it’s the nation’s wealthiest families who have led the charge to dismantle the estate tax, not its small farmers, according to an April report put together by two groups, Public Citizen and United for a Fair Economy. The analysis identified a handful of enormously wealthy families that stand to save more than $70 billion if their lobbying efforts succeed. And that lobbying effort, the report notes, has amounted to around $490 million in direct and indirect lobbying expenditures since 1998.
The list includes Ernest Gallo of the E & J Gallo Winery, based in Modesto, and John A. Sobrato of Sobrato Development, listed by Forbes as one of the largest commercial landlords in Silicon Valley, with a familial net worth of approximately $2 billion. The Gallo family is reportedly worth about $1 billion.
The rest of the list is in part a who’s who of America’s billionaires: Wal-Mart’s Walton family; Charles and David Koch of the nation’s largest privately held company, the Kansas-based Koch Industries (also benefactors of libertarian think tank the Cato Institute, founded in San Francisco); and the Dorrance family of the Campbell Soup Co.
Ernest Gallo’s participation in antitax measures is particularly well documented. Elected officials he has supported with contributions in the past sponsored federal legislation in the ’70s and ’80s that allowed for millions of dollars in estate-tax exemptions for the Gallo family. One bill was even dubbed by estate-tax supporters the “Gallo amendment.”
The Public Citizen report links the Gallos to anti–estate tax lobbyist Patricia Soldano and her Orange County–based Policy and Taxation Group (PTG), which has spent $4 million lobbying solely against the estate tax since 1998. While the authors are unable to pinpoint exactly how much the Gallos had given to PTG directly, both the Sobratos and the Gallos are listed as clients of the group. The Gallos have reportedly spent hundreds of thousands of their own dollars supporting individual candidates.
It’s doubtful that very many people who actually paid estate taxes last year would know how to repair a grain harvester. In 2001, Johnston of the Times famously challenged the anti–estate tax American Farm Bureau Federation and the Bush administration to find just one example of a farm estate being sold to pay the taxes on it. Johnston reported they were unable to do so.
Estate planner Schiller likened opponents of the estate tax to medieval villagers who complained of gout to prove how well nourished they were.
“People want to believe they have an estate-tax problem,” he said, “so they can feel successful.” SFBG

Public power: step one

EDITORIAL Finally, after years of talk and a fair amount of delay, San Francisco is prepared to move forward and take a significant step toward public power. The supervisors are on board, the mayor’s on board — even the San Francisco Public Utilities Commission, which has never been much of an advocate for public power, seems to be on board.
So the goal now ought to be approving the Community Choice Aggregation program, putting it into action, and using it as a springboard to a real public power system.
Community Choice Aggregation creates the equivalent of an energy co-op. The city can buy power in bulk, directly from generators, and resell it to residents and businesses at lower rates than the private monopoly Pacific Gas and Electric charges. It will, of course, save the ratepayers some cash — and with PG&E’s soaring rates sucking hundreds of millions of dollars out of the local economy and hammering small businesses, that’s a great thing.
But the overall point of this ought to be getting the city into the business of selling retail electricity — and getting the public used to the idea that running an electric utility is something local government tends to do well. Public power cities all over California have lower rates and more reliable service than cities that deal with PG&E. PG&E’s public relations crew and expensive political consultants try to obscure that fact every time a full-scale public power measure goes on the ballot.
The problem is that CCA doesn’t entirely get San Francisco out of PG&E’s control. The giant utility still owns the lines, polls, and meters, so the city will have to pay to deliver its power through that system. If the system breaks down, we’ll have to rely on PG&E to fix it. And if PG&E continues to handle the billing functions, most residents may never realize that there’s been a dramatic change in the local grid.
As a first step, the supervisors need to demand that the city handle the billing functions, so that ratepayers see a bill coming from the city of San Francisco, not PG&E. That will reinforce the fact that this is public power and that the city, not the private monopoly, is responsible for the rate decrease.
Then public power advocates need to set a target date for another electoral campaign to kick PG&E out of town altogether. SFBG

Thinking outside the pipe

OPINION Although it’s named the SF Sewer System Master Plan Project, San Francisco’s long-term wastewater program deals with a lot more than sewage. It addresses stormwater runoff as well as the used water that drains out of our residential and commercial sinks, toilets, showers, and washing machines. It offers us a choice between the high road of environmental justice, sustainability, and the emerging green economy and the heavily engineered “pump-and-dump” approach that has defined the city’s sewage and stormwater management practices since San Francisco was first settled.
The high road views the water that we use and that falls on our city as a resource that is too good to waste. San Franciscans now have a once in a generation opportunity to put that idea into practice through a range of innovative technologies, design techniques, and “out of the pipe” thinking. Just a few of the possibilities: building compact facilities to treat our wastewater closer to where it is first generated and where it can be reused, rather than pumping it all into one community where it can become a nuisance; transforming our streets, parks, and school yards into a network of green, healthy corridors that are vital parts of our drainage management system; and harvesting stormwater through green roofs, cisterns, and permeable surfaces.
The high road not only creates jobs for the skilled trade workers who will be needed to rebuild and upgrade the system but also provides opportunities for training and employment for younger and lower-skilled workers to maintain our green infrastructure. While many of the Public Utilities Commission staff have embraced these alternatives, public support will be critical to overcoming the institutional bias for the status quo.
Today stormwater and sewage are considered waste to be made invisible, quickly pumped somewhere for treatment, then dumped. The resulting wastewater system places 80 percent of San Francisco’s sewage treatment burden — and its accompanying problems — in the already mistreated Bayview–Hunters Point neighborhood. During rains the water that falls on the streets is quickly routed down storm drains and toward the city’s treatment facilities. Under normal circumstances the stormwater and sewage are treated, then discharged 800 feet offshore into San Francisco Bay and into an “exemption zone” in the Monterey Bay Marine Sanctuary, four and a half miles into the Pacific Ocean.
But rains overwhelm the system between 10 and 20 times every year, resulting in neighborhood flooding and overflows of more than a billion gallons of minimally treated sewage and stormwater along our waterfront annually. Since the rains are diverted into pipes instead of being absorbed into the ground, the west-side aquifer that supports Lake Merced and Pine Lake is starved of water.
The planning process now underway gives us an opportunity to address these problems. The sewer master plan provides a variety of ways for San Franciscans to get involved. They must do so to build the type of wastewater system that we can be proud of. SFBG

In Sacramento, Washingon D.C., and most of the rest of this country, politicians and the electorate shrink in the face of Chamber of Commerce complaints that some regulation or piece of legislation will hurt the economy and cost jobs. It doesn’t matter that it often isn’t true, or that the benefits outweigh the costs, or that such comments are clearly driven by naked self-interest. The fact is, in this fearful country, it’s a tactic that works over and over again. The boy keeps crying wolf and we keep running for cover.
San Francisco is proving to be different. The living wage law passed a couple years ago has proven to be a huge success with little downside and this summer’s health care mandate is also filling a troubling void left by the much hallowed market. Next comes a measure by those scrappy and effective activists over at Young Workers United: a measure for the fall ballot requiring employers to provide their workers with paid sick days.
The Chamber is already howling — surprise, surprise — but the reality is this measure will be good for both employers and employees, it’s almost sure to pass, and it will help boost progressive voting power this November.

“Inclusionary housing program” is a bureaucratic term that seems to invite mental drift. And when the Board of Supervisors’ Land Use Committee considered updating the program’s standards July 12, there was enough mind-numbing economic and regulatory minutiae to sedate the standing-room-only crowd.
But there were also diamonds in that jargony rough. For one thing, San Francisco is now poised to finally force housing developers to spend more of their astronomical profits on housing that sells or rents for far less than the city’s equally obscene housing market dictates. And that’s been made politically possible by an unlikely deal that has downtown developers such as Oz Erickson, affordable housing activists including Calvin Welch, the market-friendly Mayor’s Office of Housing, and progressive Sup. Chris Daly all on the same side.
In the process, a city-commissioned report has lifted the financial veil from big-money housing development in San Francisco, revealing that those who build the biggest high rises require a profit margin of at least 28 percent — or a take-home profit of about $250 million — before they’ll take on a project.
“It used to be illegal [usury to seek such high interest on loaned money], so 28 percent is a sobering number,” Welch said at the hearing.
The public good likely to come from this ordinance — if the current compromise can hold for a few more weeks — is a fairer system for getting people into below-market-rate (BMR) units, policies designed to encourage more housing construction for a wider income mix, and ways to involve more developers and phase in the program so as not to disrupt ongoing projects.
But before we get too deep into the program’s details, let’s take a step back, because the backstory of how we got to this compromise is an intriguing tale with important political implications, particularly for downtown’s current public enemy number one: Chris Daly.
The story really began last summer when the developers of those big new luxury high-rise condos known as One Rincon Hill were trying to get their final approvals. Daly and many of his constituents were concerned that this lucrative project didn’t include enough community benefits or BMR housing.
So the supervisor stepped in and negotiated with the developer a $120 million deal with a huge low-cost-housing element. In the end, the developer agreed to provide affordable units equivalent to about 25 percent of the project.
That’s more than double the city’s current inclusionary housing requirement, which mandates that 12 percent of the units be available below market rate. The requirement rises to 17 percent if the units are built off-site, and developers can pay the city a fee in lieu of doing the actual construction.
The deal got Daly thinking: If the Rincon developers could afford 25 percent, then others probably could too. So he used some of the developer’s money he’d extracted to fund a study looking at how increasing the mandates to 20 and 25 percent would impact housing construction in the city.
Last fall, the Planning Department and Mayor’s Office of Housing assembled a technical advisory committee — made up of cochairs Erickson and Welch and a mix of for-profit and nonprofit developers plus community representatives — to work with the study’s consultants.
Daly put his efforts in the form of an ordinance last October. Sup. Sophie Maxwell also had introduced legislation to strengthen the inclusionary housing program, which has been combined with the Daly legislation. And Sup. Jake McGoldrick last fall introduced legislation to apply the program to buildings of five or more units (it now applies to buildings of 10 units and more), and his ordinance is now being considered along with the Daly-Maxwell legislation.
“This is about housing for everyday people in San Francisco,” Daly said at the July 12 hearing, which was attended by the three supervisors, city staff and consultants, top developers, and a large crowd of housing activists wearing “Housing Justice Now” stickers.
That volatile mix produced a surprising amount of unanimity and compromise (although the Land Use Committee ultimately decided to push the matter back a week to work out some details). Just a few days earlier, when the consultants’ numbers first came in, the measures had seemed headed for an ugly showdown between the progressives and downtown.
The report by Keyser Marston Associates analyzed how much the city can ask for before developers just say no. It was a wake-up call in many respects, showing that San Francisco developers and their financers expect at least 18 percent profit margins for small projects and more than 28 percent for big ones.
For starters, that means that no private developer will build new rental housing in San Francisco, because the profits aren’t high enough. The report also says that developers will avoid putting affordable units in their luxury condo towers; it makes more economic sense to build them off-site or to pay into the city fund instead.
Doug Shoemaker of the Mayor’s Office of Housing (MOH) said his office has learned a lot from the study, particularly about how the in-lieu fee could be adjusted to make BMR housing construction a more attractive option for developers.
“It’s created a bias for developers to just pay the fee,” Shoemaker said, noting that his office increased the in-lieu fee by 15 percent on July 1 and indicating that further increases could be on the way. In fact, one requirement of the ordinance is for the MOH to regularly update fees to reflect evolving market realities.
Yet there was also a potential kiss of death in the report, which ran the numbers and found that developers wouldn’t pursue projects that met the 20 to 25 percent inclusionary housing standard that Daly was seeking.
Daly and his housing activist constituents understood that the report — which was issued just five days before the hearing — would likely translate into a mayoral veto of the legislation, allowing Mayor Gavin Newsom to claim it would hurt the city’s economy and housing needs.
“What we were confronted with last Friday was political death,” Welch said.
So Daly lowered his requirement to 15 and 20 percent respectively and agreed to compromises that grandfather in projects now in the pipeline and ease up the standards on projects that work within their current zoning.
“We do support the compromise,” Matt Franklin of the MOH told the Guardian.
But for Daly the legislation is about more than percentages. For example, it also creates standards for marketing the BMR units to prevent fraud, allows lower-income residents to qualify for them, and requires off-site BMR units to be within one mile of the project.
Daly, a tough former housing activist known for sometimes taking strong and unbending progressive stands, told the Guardian that this deal is consistent with his approach: “Yes, I’ll push the envelope, but that doesn’t mean I won’t take a good deal.”
The July 12 hearing demonstrated that this was a deal being grudgingly accepted by all of the usually polarized sides.
“We, by and large, support this legislation,” Erickson — the Emerald Fund developer and San Francisco Planning and Urban Research Association board member who cochaired the committee — said at the hearing. He also added, “I think it’s doable. I think it’s not going to kill development.”
Yet he also emphasized that the development community is giving all it can: “Fifteen percent was a compromise and we were very reluctant to see it go from 12 to 15 percent.”
Welch also said the compromise was painful for housing activists, who were hoping to get more BMR units out of market-rate housing developers and were astonished at the huge profit margins that are expected by developers and those who finance their projects.
“I think we have been successful at coming up with public policy that meets the needs of developers and low-income residents,” Welch said at the hearing.
Later he told the Guardian that the inclusionary housing update is designed to promote the kind of housing — BMR units for those making just less than the median income — that is also being created by the controversial practice of evicting tenants from apartments and converting those units into condos.
“What this does is help prevent the rental stock from being converted by [tenancies-in-common],” said Welch.
Developer Mike Burke took issue with the criticism of developers at the hearing. “It’s not a guarantee of a 28 percent return. It’s a fair return based on a substantial risk.”
Yet housing activists note that developers already anticipate delays and other financial risks when constructing their financial models, so many developers actually make more than 28 percent on their projects, a fact that the consultant’s report acknowledged.
Eric Quesada of the Mission Anti-Displacement Coalition called on city officials to adopt as tough a standard as possible, using that as a starting point to a broader discussion.
“We need to dig deeper to look at what the goals of San Francisco are for housing,” he said. “This is the ceiling of what we need.” SFBG

Ma’s moneybags

As many predicted, late independent expenditures on behalf of District 12 California Assembly candidate Fiona Ma are flooding into the race, aimed at tarnishing her opponent, Janet Reilly, with Web ads, TV spots, and mailers. To date, more than $750,000 has been spent by nine IE committees supporting Fiona Ma. In addition to the million dollars flowing through her campaign’s piggy bank, that bumps her into the bucks-deluxe category of the 2006 primaries.

More than $500,000 comes from the Sacramento-based Leaders for an Effective Government, which got its initial funding from Ma’s former boss and current political benefactor, powerful former senator John Burton. The other eight IEs are Californians United, Professional Engineers of California Government, Cause Law Enforcement Independent Expenditure Committee, San Francisco Association of Realtors, Peace Officers Research Association, Committee for a Better California, Teachers United with Firefighters and Correctional Officers, and Asian American Small Business PAC. All are based in Sacramento or Los Angeles and have an incestuous web of contributing organizations, in some cases with the same contact information (none of which returned Guardian phone calls).

The Reilly campaign made a big stink back in April when Leaders for an Effective Government spent $33,000 on pro-Ma mailers. The campaign filed complaints on April 27 with state attorney general Bill Lockyer, San Francisco district attorney Kamala Harris, and the Fair Political Practices Commission, claiming an illegal connection between the IE, Burton, and the Ma campaign. It still stands by those concerns, citing a state law that bans coordination between an IE and the campaign its spending benefits.

"Bullshit," Burton told the Guardian when asked about the complaints filed by the rival campaign. As far as his relationship to Ma’s campaign goes, he said, "I don’t have a fucking story. I’m helping her campaign." He claimed no connection to the half million spent on her behalf, but did admit to being a big early benefactor of Leaders for an Effective Government.

Ma is benefiting from the lion’s share of that IE’s spending, although it also spent $33,900 on the Johan Klehs campaign for California Senate. While Districts 18, 45, and 69 are seeing a lot of financial activity, no other Assembly race comes close to touching Ma’s IE total, with the second highest clocking in around $300,000.

"It could be the most expensive primary race ever," Bob Stern, president of the Center for Governmental Studies, told us.

While an IE’s intervention probably isn’t illegal, "it has made campaigns dirtier," said Theis Finlev, a policy advocate for Common Cause. IEs have found new life breathing the polluted air of Proposition 34, passed in 2000 with the good intention of capping amounts of campaign contributions to control the financial investments of special interests. Unlike with campaigns, there’s no limit on how much an individual can contribute to an IE.

"The point of limits is to look like you’re not beholden to anyone, but this is a huge economy with many interests concerned about what happens in Sacramento," said Finlev. In addition to having no spending limits, IE committees disclose contributors at different intervals from campaigns and typically don’t start spending money until weeks before the election.

"It’s like a shell game," Finlev said. "Wealthy contributors can hide until after the election is over."

When asked about the money IEs are spending for Ma, campaign spokesperson Tom Hsieh aligned it with Reilly’s use of personal finances. "Janet and Clint Reilly have spent over $300,000 to date. They’ll probably spend another $400,000 to $500,000 by the end of the election," he conjectured.

Reilly spokesperson Eric Jaye said it was unlikely they’d spend much more: "She’s near the limit. If she has to search the couches, she will."

"We’ve been outspent in the last four weeks at least two to one," Reilly told us. She hopes to keep up financially, but she was critical of the contributing sources of the IEs. "It’s the tobacco lobby, the liquor lobby, large developers, gaming industries, spending unprecedented amounts of money getting Fiona Ma elected."

"I believe the campaigns are equalized by those contributors," Hsieh said, but claimed no control over any of them. "Fiona does not support any of those industries." He said there wasn’t much they could do about the fortuity of hundreds of thousands of dollars being spent to support Ma.

"People in this district should be making the decision," Reilly concluded. "Not the Sacramento insiders." SFBG

A dose of reality on immigration

EDITORIAL The massive immigrant rallies, marches, and work boycotts on May 1 may have been an inconvenience to some, and the sight of tens of thousands of undocumented workers demonstrating in the streets may have offended a few politicians, but that’s true with all great social movements. And there’s little doubt that this is a new, great social movement.

The point of the May Day actions was to demonstrate the economic importance of immigrants and to send a not so subtle message to Congress that punitive, regressive immigration "reforms" won’t be tolerated quietly. The legislators in Washington, DC, can debate the finer details of amnesties and guest-worker programs, and the activists can argue over political tactics, but there are a few key points that should never get lost.

Immigration can’t be addressed with fences, border patrols, and felony prosecutions. As long as economic conditions in places like Mexico and Central America (and political conditions in dozens of other places) are dismal, people will try to come to the United States and they will always find ways of getting here.

The overwhelming majority of those immigrants contribute mightily to the nation’s economy and to the fabric of society. The waves of immigration over the years have always made this a better country.

The laws that criminalize undocumented immigrants are cruel, sometimes deadly, and immensely expensive. They’re also a complete failure, and always will be.

The only way to really address this issue is to get beyond the rhetoric and face some facts:

The reason most immigrants come to the United States is economic necessity. If we want fewer people from Mexico crossing the border, then we can help them make a decent living where they are. Imagine what $277 billion (the amount the United States has spent to date on the war in Iraq) would do for economic development in neighboring countries.

Big corporations love "free trade” agreements, but in the United States those deals only allow money and goods, not people, to move freely. In Europe, people can move too but to make that possible, the wealthier nations of the European Union have poured billions of dollars into the less developed areas.

There’s no way to get rid of the 12 million people who are living illegally in the United States, and even talking about it is a terrible idea. Offering them all citizenship, today, would solve a whole lot more problems that it would create. People who don’t fear deportation can fight abusive landlords, take sick kids to clinics, join labor unions, vote, and refuse to accept economic, political, and social abuse.

And that’s better for everyone. SFBG

The great e-mail debate

TECHSPLOITATION Geeks turn social events into intellectual debates, so it should be no surprise that intellectual debates are often an excuse for geeky socializing. This was certainly the case at a recent benefit for the Electronic Frontier Foundation (my former employer), held at a San Francisco indie movie theater known for its seedy-progressive ambiance. We were there to ponder nothing less than the future of the free world — at least, if you define "free world" as free e-mail, which is something I know all of us have done once in a while.

Most people already pay an ISP for Internet access, so the notion of having to pay for e-mail on top of that is a fairly repugnant one. But that doesn’t mean there aren’t lots of companies who’d like to make a business model out of it. A case in point is Goodmail, a Silicon Valley start-up that provides a middleperson service called e-mail certification. Companies and banks that send bulk e-mail pay Goodmail to verify their authenticity, and Goodmail passes a cut to ISPs like AOL or Yahoo!, who whisk the certified mail past their spam filters and on to your in-box. The idea is that Goodmail’s certification helps e-mail recipients tell the difference between phishing e-mails and real requests for information from their banks.

Public sentiments went sour when AOL announced it would be using Goodmail because it sounded a lot like a pay-to-play system in which only wealthy customers could afford to get their messages past the ISP’s notoriously clueless spam filters. That could mean more spam rather than less. Worse, it would impair free speech on the Net. Nonprofit bulk mailers like activist group MoveOn might get their mail blocked simply because they couldn’t afford certification. Nearly 500 nonprofit groups, fearing this scenario, signed an open letter the EFF wrote to AOL asking it to drop Goodmail’s certification system.

Longtime EFF supporter and former board member Esther Dyson, however, objected to the campaign against Goodmail. As a free-market idealist, she welcomes any new business model for handling e-mail — and particularly for tackling the epidemic phishing problem — and felt that Goodmail shouldn’t be discouraged from testing its mettle in the marketplace. When I argued with her about this at a recent conference, she threw down the gauntlet. "I’d like to debate EFF about this publicly — you tell them that," she said. Dutiful Dyson fan that I am, I made a beeline for Danny O’Brien, the EFF’s activism coordinator and spam policy wonk. As soon as the two of them started bickering about e-mail protocol SMTP, I knew the fight was on.

A couple months later, I sat with about 100 other geeks who’d come to watch O’Brien ask Dyson why she wants e-mail senders to pay for the privilege. Turns out Dyson’s perfect universe doesn’t involve a Goodmail-style model. Instead, she favors a system wherein e-mail recipients are paid to read e-mail — if you thought a piece of mail is spam, you’d have the option to bill the sender. If you wanted the mail, you could accept it without charge. Although Dyson admitted this system might require an unwieldy billing infrastructure and many market mishaps, she’s nevertheless "pro-choice" when it comes to companies — even Goodmail — experimenting with business models for an e-mail system that, she concluded, "simply can’t be free anymore."

O’Brien, for his part, made an impassioned case for the spam and phishing problems to be solved via social economies like the ones that have made Wikipedia and many open source projects so successful. "Solving this by falling back on the monetary economy is an incredibly old-fashioned and conservative move," he said. He urged everybody to look for nonmonetary economic solutions whereby communities collaborate to build tools that help certify legitimate mail and filter out spam and don’t force people to pay cash to engage in free speech.

EFF founder and techno-freedom philanthropist Mitch Kapor, who moderated the debate, ended the evening by saying that nobody had won. "We’ll see who turns out to be right in the future," he said, laughing. For my part, well, I’m a social economy idealist. In my perfect future, a hell of a lot more than e-mail will be free. But keeping one of the greatest engines of free speech from backsliding into the monetary economy is a good start. SFBG

A strong small-business agenda

EDITORIAL You read the academic journals these days, or peruse economic-development Web sites, and everyone seems to be talking about sustainable urban economics. It’s as if the mantra that was first put forward by Jane Jacobs, David Morris, and a few others a quarter century ago is very much in the mainstream today: Cities function best with diverse economies dominated by locally owned businesses, with money circuutf8g within the community. Cutting-edge restaurants talk about serving locally grown food. Beverage savants want local beer and wine. Just about everyone — including the mayor and the San Francisco Chamber of Commerce — wants to participate in a program called Shop Local.

It’s a wonderful, encouraging trend — but if it’s going to make any real difference in this city, it has to become a lot more than lip service. Consider: Just as Mayor Newsom was proudly signing on to a Shop San Francisco program, the mayor and the supervisors were busy approving plans to allow Home Depot — an anticompetitive out-of-town corporation that destroys local small business and undermines the entire concept of a strong local economy — to build a giant store on Bayshore Boulevard.

 It’s taken legal action by Sue Hestor and the neighborhood leaders to derail (for now) the mayor’s plans to build high-end condos all over the eastern neighborhoods — threatening hundreds of locally owned businesses.

Downtown business leaders and the groups they fund still push for policies that hurt most of the businesses in the city — and too many small-business people still go along.

Here’s the reality: Supporting small businesses — and moving San Francisco toward a sustainable economy — requires a lot more than a slogan. The people who are behind the Shop Local movement know that. They’re promoting a wide range of national and local policies designed to change not only attitudes but the direction of public policy.

San Francisco, a progressive city known for its wonderful, lively, unique neighborhoods, ought to be a national leader in the battle. But others (Philadelphia, for example) are moving way ahead. This city is still stuck in an ancient (and regressive) economic mind-set.

There are a number of key things the city can do to turn that around and become a truly small-businessfriendly place — and most of them go far beyond public-relations efforts and cutting through red tape. The basic approach to policy needs to change; here are a few ways to start:

 Stop allowing big chains to come into town. That’s not exactly rocket science, and it isn’t so hard either: Hayes Valley and North Beach both have "formula retail" laws that restrict the chains, and there’s talk of doing the same in Potrero Hill. But why does this have to be fought block by block? Why not a citywide ordinance that protects every neighborhood commercial district — and, more important, keeps the life-sucking big-box giants away from the city altogether?

 Make small, locally owned businesses part of the planning process. The city’s own (limited) studies have made clear that the type of development the mayor and the current city planning leadership has in mind would damage local businesses, particularly in the repair, distribution, and small manufacturing areas. That alone ought to be grounds to change directions. Why not a checklist for every new project that includes the question: Will this displace existing locally owned businesses? If the answer is yes, the project should be rejected.

Take progressive business taxes seriously. There’s almost certainly going to be an effort this fall to change the city’s business-tax structure, with one of the goals being an increase in overall revenue. That’s great, and it ought to happen — but the tax rates have to be shifted too, so that a tiny local retail outlet doesn’t pay the same amount as the Gap. (Socking big-box outlets with a special tax or fee — possibly based on the fact that they are by nature car-driven operations — might be a nice way to bring in some cash.)

You can’t be friendly to small local businesses these days without taking sides in the national economic war — and that means coming out against the big chains. Until San Francisco does that, all the talk of supporting local merchants will amount to nothing. SFBG

Saluting small business

  Back in my hometown of Rock Rapids, Iowa, a flat land of tall corn and homestead farms way out in northwest Iowa, my grandfather and father ran a small, family owned drug store for more than seven decades. Their slogan, known throughout the territory, was "Brugmann’s Drugs: Where drugs and gold are fairly sold, since l902."

   The town was then and still is about 2,800 in population, and we were miles away from the nearest cities of Sioux Falls, South Dakota, and Sioux City, Iowa. The merchants, and the farmers and townsfolk who patronized them, had to go it pretty much alone and depend on each other for economic sustenance.  The two Brugmann families bought shoes at Jensen’s and Hornseth’s shoe stores, purchased clothes that often didn’t quite fit at Bernstein’s department store, bought our groceries from Bob Bendinger and Tony Sieparda’s grocery stores, ate meals out at Jay’s and the Grill Café, banked at the Rock Rapids State Bank and later the Lyon County bank,  went to endless church suppers in town and in the country to support the local churches, hired Jim Wells to do our taxes, used both Doc Wubbena and Doc Cook, the town’s two doctors, and had our teeth done by Doc Lee and Doc Fisch.

   My dad, as the town pharmacist, would often get called at night, sometimes twice, to go down to the store and fill a prescription for one of the doctors tending a patient who needed emergency help. My wife’s father, who owned a lumberyard in Bennet, Nebraska, and later a hardware store in Le Mars, Iowa, followed the same routine. As did her grandfathers, one who founded banks in small towns in Nebraska and Kansas, another who ran a grocery store in Topeka, Kansas.

   I asked my grandfather and my dad why they went out of their way to do all these things in town and why I always got pulled along as Con Brugmann’s boy. "We want to keep our money working in town," they would reply. "That helps the store and that helps the town." I also asked why they put regular ads in the local Lyon County Reporter, run by Paul Smith as the fourth generation of the pioneering Smith family, when everybody already knew what the store offered in merchandise and service. "That’s the price of having a good local paper in town,” my dad would say.

   Significantly, Brugmann’s Drugs and our old store building have been transformed into the B and L café, a friendly oasis featuring yummy homemade pies and soups and a unique setting full of antique furniture. It is owned and operated by Beth and Lawrence Lupkes, a husband and wife team who work long and hard to keep the café going from dawn till dusk seven days a week. Their key to economic sustenance: they keep their “day” jobs, Beth as a dispatcher for the county’s emergency services, Lawrence as a rural mail carrier and mayor. Lawrence’s sister is the main cook and they press family members into service.

   When my wife Jean Dibble and I founded the Guardian in l966, we quickly found that the cooperative small business way of life that worked in little towns in Iowa and Nebraska and Kansas worked the same way in San Francisco with its tradition of neighborhoods and communities. Small business, we found, was not only the leading job generator and a key piece of the city’s urban fabric. Small business was critical to building sustainable local economies in San Francisco and most other cities. Jean and I like to think that the Brugmann and Dibble families have been continuously making small business contributions to our communities since l902.

   A long list of studies shows that small businesses keep more money circuutf8g in the local economy than big chains. The chain money is wired out of town every night—and chains are more likely to buy from other chains, in bulk, and thus rarely patronize other local businesses. So very little of the dollar you spend at a chain store stays in the community, which means its impact on the local economy is negligible. Money that stays in town creates more jobs, more business activity, a more stable economy and a larger tax base. Thankfully, no Wal-Mart came to the Rock Rapids area, but Wal-Mart came to several other Iowa communities with disastrous consequences to the downtowns and local tax bases of three towns and seven counties.     When academics and policy makers around the country are increasingly discussing ways that cities can be more self-reliant, work more with local resources and thus be both environmentally and economically stronger, they are talking about the value of small, locally owned, independent businesses.

    Economies are all subject to business cycles. If a city’s economy is dominated by a monocrop and or a few big companies, the entire economy suffers when they take a hit. Rock Rapids is tied to the farms and the weather.  Detroit’s fate is tied to the auto industry. If Microsoft and Boeing have blips, the impact is felt across Seattle. But a community with many different local businesses in many different niches is much more able to survive and even prosper in tough times.  After the l906 earthquake, it was the entrepreneurs and small businesses that lifted the city from the ashes. After the dot-com bust, it was again the small businesses and the entrepreneurs who are helping cushion the blow and leading the recovery.

    The bottom line is that the big chains see a community like San Francisco as a place to extract money from as quickly as possible, much like the strip miners in the Sierra. Small businesses see the city as a place to invest human capital to build real community—to join merchant groups, get involved in local politics, hire local kids, patronize other businesses, work to invigorate their neighborhoods, spread the gospel of shopping local. Our congratulations to the winners, all working in their own way to transform San Francisco into a sustainable local economy. And our congratulations to the thousands of small business people in San Francisco, and the merchant groups behind them, who daily struggle valiantly against daunting odds to keep their businesses going, their neighborhoods vibrant, and San Francisco an incomparably great city.

     This year, we give special recognition to Arthur Jackson, who for almost four decades helped thousands of people get jobs in small, independent, locally owned businesses through his employment agency, Jackson Personnel Agency. He died on April l0 at     age 58 after a courageous fight against a series of illnesses including a kidney transplant.  He lived his favorite quote: “Putting people to work is a passion for me, because the paycheck fully empowers our community.” Arthur, as we all called him, won our diversity in small business award last year and his name will live on at the Guardian in the form of our annual Arthur Jackson diversity in small business award.

Arnold and Emily

This is a story about a muscle-bound governor, a nine-year-old girl, and some polar bears. The governor is Arnold Schwarzenegger, the girl is Emily Magavern, and the polar bears or at least photos of them served as backdrops for a pair of speeches the two gave on global warming.

Emily, the daughter of a Sierra Club lobbyist, gave her speech in Sacramento on April 3 at a press conference outlining legislation that Democratic lawmakers have introduced to create a mandatory limit on greenhouse gases.

“I don’t want the polar bears to lose their homes,” Emily told the gathering.

That bill was triggered by a report from the Climate Action Team, which was commissioned by Schwarzenegger in June 2005 to recommend how California should address global warming. The report’s suggestions include a tax on gasoline, the monitoring of factory emissions, a cap-and-trade system (which caps the amount of greenhouse gases that factories may produce and sets up a trading market in which businesspeople can buy or sell emissions credits), as well as other less contentious initiatives.

But when Schwarzenegger came to San Francisco April 11 to outline his recommendations, he embraced almost none of the controversial schemes, with the exception of mandatory reporting of emissions (something most factories don’t now report), even as he claimed climate change to be a “most pressing issue.”

“The debate is over, the science is in, and it’s time for action,” boomed Schwarzenegger, who then contradicted his own call to action by telling the crowd that he was concerned about scaring businesses out of the state. “Must take cautious steps and the right steps.”

There are telling contrasts between the approaches of our tough-talking governor and this soft-spoken little girl. In some ways it seems their roles are reversed, with Schwarzenegger unwilling to connect cause and effect and Emily taking a more mature view of the problem.

Emily diagnosed what is essentially a simple problem. Humans are causing cataclysmic, global climate changes through excessive consumption of fossil fuels. The changes are having a negative impact on many species, including polar bears in the Arctic and animals closer to home, like California’s state bird, the California quail.

Some of the top contributors to the problem are the humans living right here in California, which is the world’s 12th largest producer of greenhouse gases, of which 58 percent come from cars. The solution: Burn less fossil fuel, even if that’s a difficult thing to do.

“We can’t rely on oil forever,” Emily said.

In contrast, Schwarzenegger spun a compelling vision of what California’s future would be like if it cleaned up its greenhouse gas emissions. Yet he remains politically intimidated by business interests, such as the California Chamber of Commerce and the California Manufacturers and Technology Association, which says that addressing global warming would hurt the state’s economy.

In the beginning of his speech at San Francisco City Hall, Schwarzenegger touted the need for immediate action by developing a mandatory reporting and cap-and-trade system, emphasizing the economic benefits of recently implemented initiatives. Yet he later said he opposed caps, leaving it unclear how such a system would work or exactly what he’s calling for.

“We should start off without the caps until 2010,” Schwarzenegger said. “Caps could scare off the business community.”

Schwarzenegger’s response has many global warming advocates feeling deflated, while a number of businesses are breathing sighs of relief. The governor also appears to be letting the driving public off the hook by refusing to support the gas tax that his committee recommended, a problem addressed by Emily.

“If people try to not drive cars as much and try to drive cleaner cars, that would help the problem,” Emily said.

There are also many grown-ups out there who agree with Emily and say that dealing with global warming may be difficult, but doing so proactively and taking a lead role in the effort might actually help the state’s economy by encouraging development of new technologies and industries rather than hurt it.

“The chamber’s very good at having 20/20 vision in the rearview mirror,” said Bob Epstein, cofounder of Environmental Entrepreneurs. “All businesses need are the creation of simple rules, and then the legislators can step back and let business innovate.”

That seems to be what the legislature is trying to do, with Assembly Bill 32 seeking to cap factory emissions and reduce them by 30 percent by the year 2020. But whether the governor will sign this bill (and others to come) and start saving the polar bears and Emily’s generation is a question he seems unwilling to address. SFBG

 

Invisible minority

A new community-based research report on Pacific Islanders Tongans, Samoans, Hawaiians, Fijians, and other Polynesians reveals disproportionately high dropout, arrest, and depression rates among the population in Oakland.

In the 2000 to 2001 school year, for example, 47 Pacific Islander ninth graders were enrolled in the Oakland Unified School District. By the 2003 to 2004 school year, when those students would have been seniors, only 14 Pacific Islanders were enrolled in the 12th grade.

Pacific Islander youths also have the second-highest arrest rate in Alameda County and the highest arrest rate about 9 in 100 Pacific Islanders each year in San Francisco County, according to the Asian/Pacific Islander Youth Violence Prevention Center.

Often grouped under the larger Asian and Pacific Islander category, Pacific Islanders’ experiences are overshadowed by larger groups like Chinese and Japanese Americans.

"We’re invisible," Penina Ava Taesali, a researcher of the report, told the Guardian. "All we have is anecdotal data on issues. In every segment of the government city, county, state, and federal there’s no data."

Taesali, who is the artistic director of Asian/Pacific Islander Youth Promoting Advocacy and Leadership, said that when she first began working for AYPAL eight years ago, she expected to see a program for Pacific Islander youths and was surprised to see none. She helped create the youth program Pacific Islander Kie Association (PIKA) in 2001.

She is among those now trying to figure out why this relatively small cultural group is having such disproportionate problems and how they might be solved.

Culture Clash

The first wave of immigration from the Pacific Islands came after World War II. During the war many Pacific Islands, including Hawaii, Tonga, and Samoa, were occupied by US troops. Previous to that, many Pacific Islands were colonized by Europeans.

After the United States loosened its immigration policies in 1965, more and more Pacific Islanders moved to the US, as well as to New Zealand, Australia, and Canada. First men, then women, moved abroad for better jobs to send remittance back to the islands. Between 1980 and 1990, the US population of Tongans rose 58 percent.

When the 2000 US census was released, many were also surprised to learn that there are more Pacific Islanders living in California than in Hawaii: 116,961 compared with 113,539. The Bay Area including Oakland, San Francisco, and San Mateo is home to 36,317 Pacific Islanders.

Now a new generation of Pacific Islander Americans is growing up and learning to navigate family, school, and church but many are feeling alienated from all three social structures.

"A lot of times, within Pacific Islander families, the children are very much seen but not heard," Venus Mesui, a community liaison at Life Academy and Media Academy high schools in Oakland, said. "They’re not really able to express themselves at school or at home. Depression comes along with that, because they don’t have the know-how to express themselves in a positive manner. They don’t have a space, or they don’t feel safe, to voice their opinions."

The report also revealed that several youths who were interviewed said domestic violence and corporal punishment occurred within their families.

Pelenatita "Tita" Olosoni, 18, told us she wished more parents would visit the schools to see what’s really going on.

"Parents think school out here is easier than back on the islands," Olosoni said. "It would be helpful if they took time off from work to see what kids are going through every day."

According to Mesui, parents need to be trained in how to support their children, particularly if they attend underperforming schools.

"I know all of the parents want their kids to succeed, but unfortunately, older siblings are asked to take care of the younger ones, and this doesn’t prepare them with good habits that will make them successful in school," Mesui, who is Hawaiian, said.

Olosoni said she and other Pacific Islander students have had to stay home and miss weeks of school to take care of their younger siblings and cousins.

Christopher Pulu, a 15-year-old freshman at Oakland High whose father is a landscaper, said, "That’s what the majority of our fathers do." Most Pacific Islanders in the US are laborers, and 32 percent live below the national poverty level, according to 2000 US census data.

"They always need an extra hand," Olosoni told us. "So the boys will drop school and see it as an easy way to make money and work with their dads."

"Big-boned and heavy-handed"

Like many minority groups, Pacific Islanders suffer from stereotypes. The prevalent minority myth that all Asians (though most Pacific Islanders do not consider themselves Asian) do well in school actually hurts groups like Pacific Islanders, Cambodians, and Hmong, according to Andrew Barlow, a sociology professor at UC Berkeley and Diablo Valley College.

"Most people say we’re big-boned and heavy-handed," Olosoni said. "When Tongans get in trouble, the whole Tongan crew gets in trouble."

Olosoni remembers the day she, her sister, and three friends were called into the principal’s office after a lunchtime fight at Castlemont High School in East Oakland. The security guard called another guard on his walkie-talkie and said, "Gather all the Tongans in the office," Olosoni recalls.

"I was like, ‘No, they didn’t go there,’" she told us. "It was just the five of us involved in the fight, but they called in all the Tongans." After the fight, the five Polynesian girls were given a one-week suspension.

Because Pacific Islander youths only make up 1.2 percent of a district’s population, they are usually a small but visible group within each school. While security guards may not be able to call "all Latinos" to the office, for example, they can do so with a smaller population like Tongans, Barlow said. He said that being so easily targeted increases solidarity within the community but may also lead to insularity and even more stereotyping.

"When people are denied opportunities and when they’re treated unequally, the way they’re going to deal with that is increasing reliance on their community and increasing ethnic solidarity," he said.

Barlow, who teaches courses on race and ethnicity, told us stereotypes are just a part of the problem. Larger systemic issues such as the economy, access to jobs, and educational role models are just as crucial.

"Tongans are already coming into American society with a lot of problems caused by colonialism," Barlow says. "If you don’t have access to a very wealthy school district, if you don’t know people who have access to good jobs, if you don’t have a high degree of education, then you’re in trouble."

A New Generation

Pulu said he hopes to be the first in his family to attend and graduate from college. He has received at least a 3.5 grade point average every semester and attends church regularly.

At the beginning of the school year, his multicultural education teacher asked him to go to the front of the class and point out Tonga on a world map.

"It doesn’t stand out," Pulu said. He is energetic and enthusiastic and doesn’t mind educating others about his culture. "Most people think it’s a part of Hawaii."

Mesui said Pacific Islanders have come a long way. Though the report focuses on a lot of struggles, Mesui said that she has personally seen increasing numbers of Pacific Islanders graduate from high school and go on to college, including her three children.

She believes schools should address the issue of youths who don’t have support at home.

"When they’re not in school, they’re doing something else," Mesui said. "The majority of the arrests are due to them not going to school and getting in trouble on the streets. And I think it falls on the school we’re not doing something to keep them here."

Olosoni said she knows of 3 Tongan youths in the last school year who were kicked out of Castlemont out of about 15 Pacific Islander students in the school for cutting class.

"It comes from the lack of them getting help from people of their own kind to help them understand things better," Olosoni said. She is now attending adult school and working on her GED.

Over the years Taesali has pushed for more programming in the community. PIKA now has about 40 youths who meet every Tuesday afternoon at an Oakland high school.

"If we got more Pacific Islander staff and teachers, there would be immediate results," Taesali said. "I have no doubt about it."

Taesali sees Pacific Islander students engaged when they learn about their own culture.

"Every time we’ve done workshops on Pacific Islander history and culture, [the students] just don’t want to leave," she said. "They are so happy to be learning about their culture." SFBG

Shooting a pig

A good deal of blood gets spilled in Michael Pollan’s intelligently gory new book, The Omnivore’s Dilemma: A Natural History of Four Meals (Penguin Press, $26.95), but amid the accounts of chickens’ throats being methodically slit and steers’ assembly-line encounters with the so-called stunner, the shooting of a wild pig near Healdsburg commands a particularly dark fascination. For one of the shooters is Pollan himself, our guide, narrator, and conflictedly omnivorous Everyman, and his act of marksmanship in Sonoma’s golden hills closes the circle that is the book’s central conceit: of bearing personal witness to, and accepting moral responsibility for, the collection of the food one will then prepare and eat.

The breaking of that circle is a chief objective of the food industry. As Pollan notes, Big Food "depends upon consumers’ not knowing much … beyond the price disclosed by the checkout scanner. Cheapness and ignorance are mutually reinforcing … [and] the global economy couldn’t very well function without this wall of ignorance and the indifference it breeds." And even in America, ignorance and heartlessness cannot be assumed. "Were the walls of our meat industry to become transparent, literally or even figuratively," Pollan writes, "we would not long continue to raise, kill, and eat animals the way we do … for who could stand the sight?"

The pig who falls at Pollan’s shot — "a very large gray sow" — was probably shot by Pollan’s more experienced guide, or so Pollan seems to imply. Later there will be ham and prosciutto and other porcine wonders, but under the hot Sonoma sun, the immediate prospect is "a dead wild animal, its head lying on the dirt in a widening circle of blood." One cannot help admiring Pollan’s nerve, his gameness, even as the hunting episode brings forth a spasm of not quite seemly triumph — his sense of himself, candidly described, as "playing the hero’s part."

I would not, could not, shoot a pig, or any mammal, any creature — and I say this not with pride but as a fact. I recoil from accounts of Dick Cheney’s beer-bust quail hunts. If I had to do what Pollan did to eat meat, I would not eat meat. But I don’t, none of us do, and there is our dilemma.

It may not be sexy, but it’s important

The problem with reading comprehensive analyses of the state of anything — the union, the art or the economy — is that you often have to wade through a whole lot of facts and figures before you get to the good stuff. Most of us zone out when we see too many numbers in front of our eyes. No matter how interesting or important we find the topic, if a report contains more than one statistic per paragraph, we never make it to the end.

For The Bay Guardian, that has always been a dilemma. Unlike a lot of news outlets, we don’t ask you to believe our stories on faith alone; we give you the facts to back them up. Sometimes, with complicated stories, we give you so many that you can’t be bothered reading them all.

Bruce Brugmann, the editor and publisher, is fond of telling us that the headline on every story has to summarize everything important in the story. Most people, he says, won’t read anything else. If we want to make sure they get the point, we have to put it in 96-point Tempo Bold.

Which makes sense. But when the story is about the state of San Francisco’s economy and how the next mayor should guide it, the point doesn’t lend itself to a few short, bold words on the top of a page. It’s too complicated for headlines.

It’s also too complicated for short campaign slogans, or for 30-second radio and TV ads. That may be one reason why the mayoral candidates have, by and large, ignored the issue. It just isn’t sexy. It takes too long to explain. Too many numbers. The voters will go to sleep.

Unfortunately, the issue is also crucial. The economic policies of the next mayor will affect the lives of everybody living or working in San Francisco. It’s something the candidates should be talking about.

We aren’t running for public office, so we don’t need to hustle for votes. But we are concerned about the future of the city — and no matter how much work we put into a story, it does no good if people don’t read it. This week’s main news story, by reporter Tim Redmond, is full of numbers and statistics, and I’ll be the first to admit it’s

the kind of story that would normally scare me away. But the story is important, and the proposals that form the final section should be required reading for anyone interested in a serious debate over the city’s future. Give it a shot — then call your favorite candidate and ask him or her what they think of our ideas and why they aren’t discussing these issues as part of the campaign.

SF’s economic future

Sometime early this spring, while most of Washington, D.C. was watching the cherry trees bloom and thinking about the impending Iran-contra hearings, a few senior administration officials began discussing a plan to help domestic steel companies shut down underutilized plants by subsidizing some of the huge costs of pension plans for the workers who would be laid off.

The officials, mostly from the Departments of Labor and Commerce, saw the plan as a pragmatic approach to a pressing economic problem. With the steel industry in serious trouble, they argued, plant closures are inevitable — and since the federal government guarantees private pension plans, some companies will simply declare bankruptcy and dump the full liability on the taxpayers. Subsidies, they argued, would be a far cheaper alternative.

But the plan elicited sharp opposition from members of the Council of Economic Advisors, who acknowledged the extent of the problem but said the proposal was inconsistent with the Reagan economic philosophy. The problem, The New York Times reported, was that “such a plan would be tantamount to an industrial policy, an approach the president has long opposed.”

For aspiring conservative politicians, the incident contained a clear message, one that may well affect the terms of the 1988 Republican presidential debate. To the right-wing thinkers who control the party’s economic agenda, the concept of a national industrial policy is still officially off-limits. In San Francisco, the ground rules are very different. All four major mayoral candidates agree that the city needs to plan for its economic future and play a firm, even aggressive role in guiding the local economy. The incumbent, Dianne Feinstein, has established a clear, highly visible — and often controversial — industrial development policy, against which the contenders could easily compare and contrast their own programs.

The mayoral race is taking place at a time when the city is undergoing tremendous economic upheaval. The giant corporations that once anchored the local economy are curtailing expansion plans, moving to the suburbs and in many cases cutting thousands of jobs from the payroll. The once-healthy municipal budget surplus is gone. The infrastructure is crumbling and city services are stressed to the breaking point.

By all rights, the people who seek to lead the city into the 1990s should present San Francisco voters with a detailed vision for the city’s economic future, and a well-developed set of policy alternatives to carry that vision out.

But with the election just three months away, that simply isn’t happening. Generally speaking, for all the serious talk of economic policy we’ve seen thus far, most of the candidates — and nearly all the reporters who cover them — might as well be sniffing cherry blossoms in Ronald Reagan’s Washington.

IN MUCH OF San Francisco’s news media and political and business establishment these days, the debate — or more often, lament — starts with this premise: San Francisco is in a bitter competition with Los Angeles. At stake is the title of financial and cultural headquarters for the Western United States, the right to be called the Gateway to the Pacific Rim. And San Francisco is losing.

The premise is hard to deny. If, indeed, the two cities are fighting for that prize, San Francisco has very nearly been knocked out of the ring. Just a few short years ago, San Francisco’s Bank of America was the largest banking institution in the nation. Now, it’s third — and faltering. Last year, First Interstate — a firm from L.A. — very nearly seized control of the the company that occupies the tallest building in San Francisco. The same problems have, to a greater or lesser extent, beset the city’s other leading financial institutions. A decade ago, San Francisco was the undisputed financial center of the West Coast; today, Los Angeles banks control twice the assets of banks in San Francisco.

It doesn’t stop there. Los Angeles has a world-class modern art museum; San Francisco’s is stumbling along. The Port of San Francisco used to control almost all of the Northern California shipping trade; now it’s not even number one in the Bay Area (Oakland is). Looking for the top-rated theater and dance community west of the Rockies? San Francisco doesn’t have it; try Seattle.

Even the federal government is following the trend. A new federal building is planned for the Bay Area, but not for San Francisco. The building — and hundreds of government jobs — are going to Oakland.

In terms of a civic metaphor, consider what happened to the rock-and-roll museum. San Francisco, the birthplace of much of the country’s best and most important rock music, made a serious pitch for the museum. It went to Cleveland.

For almost 40 years — since the end of World War II — San Francisco’s political and business leaders have been hell-bent on building the Manhattan Island of the West on 49 square miles of land on the tip of the Peninsula. Downtown San Francisco was to be Wall Street of the Pacific Rim. San Mateo, Marin and the East Bay would be the suburbs, the bedroom communities for the executives and support workers who would work in tall buildings from nine to five, then head home for the evening on the bridges, freeways and an electric rail system.

If the idea was to make a few business executives, developers and real estate speculators very rich, the scheme worked well. If the idea was to build a sound, firm and lasting economic base for the city of San Francisco, one could certainly argue that it has failed.

NOT EVERYONE, however, accepts that argument. Wells Fargo’s chief economist, Joseph Wahed, freely admits he is “a die-hard optimist.” San Francisco, he agrees, has taken its share of punches. But the city’s economy is still very much on its feet, Wahed says; he’s not by any means ready to throw in the towel.

Wahed, who authored the bank’s recent report on the city’s economic future, points to some important — and undeniable — signs of vitality:

* San Francisco’s economic growth has been well above both the national and state average during the 1980s — a healthy 3.67 a year.

* Per-capita income in San Francisco is $21,000 a year, the highest of any of the nation’s 50 largest cities.

* New business starts in the city outpaced business failures by a ratio of 5-1, far better than the rest of the nation. * Unemployment in San Francisco, at 5.57, remains below national and statewide levels (see charts).

San Francisco, Wahed predicts, has a rosy economic future — as long as the city doesn’t throw up any more “obstacles to growth” — like Proposition M, the 1986 ballot measure that limits office development in the city to 475,000 square feet a year.

John Jacobs, the executive director of the San Francisco Chamber of Commerce, came to the same conclusion. In the Chamber’s annual report, issued in January, 1987, Jacobs wrote: “The year 1986 has been an amusing one, with both national and local journalists attempting to compare the incomparable — San Francisco and Los Angeles — and suggesting that somehow San Francisco is losing out in this artificially manufactured competition. Search as one might, no facts can be found to justify that assertion.”

Wahed and Jacobs have more in common than their optimism. Both seem to accept as more or less given the concept of San Francisco as the West Coast Manhattan.

Since the day Mayor Dianne Feinstein took office, she has run the city using essentially the policies and approach championed by Wahed and Jacobs. Before San Franciscans rush to elect a new mayor, they should examine those strategies to see if they make any sense. After nearly a decade under Feinstein’s leadership, is San Francisco a healthy city holding its own through a minor downturn or an economic disaster area? Are San Francisco’s economic problems purely the result of national and international factors, or has the Pacific Rim/West Coast Wall Street strategy failed? Is the economy weathering the storm because of the mayor’s policies, or despite them? And perhaps more important, will Feinstein’s policies guide the city to new and greater prosperity in the changing economy of the next decade? Or is a significant change long overdue?

The questions are clear and obvious. The answers take a bit more work.

SAN FRANCISCO’S economy is an immensely complex creature, and no single study or analysis can capture the full range of its problems and potential. But after considerable research, we’ve come to a very different conclusion than the leading sages of the city’s business community. Yes, San Francisco can have a rosy economic future — if we stop pursuing the failed policies of the past, cut our losses now and begin developing a new economic development program, one based on reality, not images — and one that will benefit a broad range of San Franciscans, not just a handful of big corporations and investors.

Our analysis of San Francisco’s economy starts at the bottom. Wells Fargo, PG&E and the Chamber see the city first and foremost as a place to do business, a market for goods and a source of labor. We see it as a community, a place where people live and work, eat and drink, shop and play.

The distinction is far more than academic. When you look at San Francisco the way Wells Fargo does, you see a booming market: 745,000 people who will spend roughly $19.1 billion on goods and services this year, up from $15.4 billion in 1980. By the year 2000, Wahed projects, that market could reach $229 billion as the population climbs to 800,000 and per-capita income hits $30,000 (in 1986 dollars), up from $18,811 in 1980. Employment has grown from 563,000 in 1980 to 569,000 in 1986. When you look at San Francisco as a place to live, you see a very different story. Perhaps more people are working in San Francisco — but fewer and fewer of them are San Franciscans. In 1970, 57.47 of the jobs in San Francisco were held by city residents, City Planning Department figures show. By 1980, that number had dropped to 50.77. Although more recent figures aren’t available, it’s almost certainly below 507 today.

Taken from a slightly different perspective, in 1970, 89.17 of the working people in San Francisco worked in the city. Ten years later, only 857 worked in the city; the rest had found jobs elsewhere.

Without question, an increase in per capita income signifies that the city is a better market. It also suggests, however, that thousands of low-income San Franciscans — those who have neither the skills nor the training for high-paying jobs — have been forced to leave the city. It comes as no surprise, for example that San Francisco is the only major city in the country to post a net loss in black residents over the past 15 years.

The displacement of lower-income residents highlights a key area in which San Francisco’s economy is badly deficient: housing. San Francisco’s housing stock simply has not kept pace with the population growth of the past five years. Between 1980 and 1984, while nearly 40,000 more people took up residence in the city, only 3,000 additional housing units were built.

Some of the new residents were immigrants who, lacking resources and glad to be in the country on any terms, crowded in large numbers into tiny apartments. Some were young, single adults, who took over apartments, homes and flats, bringing five of six people into places that once held families of three or four.

But overall, the impact of the population increase has been to place enormous pressure on the limited housing stock. Prices, not surprisingly, have soared. According to a 1985 study prepared for San Franciscans for Reasonable Growth by Sedway Cooke and Associates, the median rent for a one-bedroom apartment in 1985 was $700 a month. The residential vacancy rate was less than 17.

Housing is more than a social issue. A report released this spring by the Association of Bay Area Governments warns the entire Bay Area may face a severe housing crisis within the next two decades — and the lack of affordable housing may discourage new businesses from opening and drive existing ones away. When housing becomes too expensive, the report states, the wages employers have to pay to offset housing and transportation costs make the area an undesirable place to do business.

WAHED’S WELLS FARGO report shows a modest net employment gain in San Francisco between 1980 and 1986, from 563,000 jobs to 569,000. What the study doesn’t show is that the positive job growth statistic reflects the choice of the study period more than it reflects current trends. In the late 1970s and early 1980s, San Francisco experienced considerable job growth. By 1981, that trend was beginning to reverse.

According to a study by Massachusetts Institute of Technology researcher David Birch, San Francisco actually lost some 6,000 jobs between 1981 and 1985. The study, commissioned by the Bay Guardian, showed that the decline occurred overwhelmingly to large downtown corporations — the firms upon which the Pacific Rim strategy was and is centered. Since 1981, those firms have cost the city thousands of jobs. (See The Monsters that Ate 10,000 jobs, Bay Guardian DATE TKTKTK).

Some of the firms — B of A, for example — were victims of poor management. Some, like Southern Pacific, were caught in the merger mania of the Reagan years. Others, however, simply moved out of town. And no new giants moved in to take their places.

What drove these large employers away? Not, it would appear, a lack of office space or other regulatory “obstacles” to growth: Between 1980 and 1985, San Francisco underwent the largest building boom in its history, with more than 10 million square feet of new office space coming on line. In fact, the city now has abundant vacant space; by some estimates, the vacancy rate for downtown office buildings is between 157 and 207.

The decision to move a business into or out of a city is often very complicated. However, Birch, who has done considerable research into the issue, suggests in the April 1987 issue of Inc. magazine that the most crucial concerns are what he calls “quality of life” factors. Quality-of-life factors include things like affordable family housing for employees; easy, inexpensive transit options and good-quality recreation facilities and schools — and good-quality local government. In many cases, researchers are finding, companies that need a large supply of “back office” labor — that is, workers who do not command executive salaries — are moving to the suburbs, where people who are paid less than executive salaries can actually afford to live.

“Today the small companies, not the large corporations, are the engines of economic growth,” Birch wrote. “And more often than not, small companies are growing in places that pay attention to the public realm, even if higher taxes are needed to pay for it.”

For the past 20 years, San Francisco has allowed, even encouraged, massive new highrise office development, geared to attracting new headquarters companies and helping existing ones expand. In the process, some basic city services and public amenities — the things that make for a good quality of life — have suffered.

The most obvious example is the city’s infrastructure — the roads, sewers, bridges, transit systems and other physical facilities that literally hold a modern urban society together. A 1985 report by then-Chief Administrative Officer Roger Boas suggested that the city needed to spend more than $1 billion just to repair and replace aging and over-used infrastructure facilities. Wells Fargo’s report conceeds that that city may be spending $50 million a year too little on infrastructure maintenance.

Some of that problem, as Boas points out in his report, is due to the fact that many city facilities were built 50 or more years ago, and are simply wearing out. But wear and tear has been greatly increased by the huge growth in downtown office space — and thus daytime workplace population — that took place over the previous two decades.

To take just one example: Between 1980 and 1984, City Planning Department figures show, the number of people traveling into the financial district every day increased by more than 10,000. Nearly 2,000 of those people drove cars. In the meantime, of course, the number of riders on the city’s Municipal Railway also increased dramatically. City figures show more than 2,000 new Muni riders took buses and light rail vehicles into the financial district between 1981 and 1984. Again, city officials resist putting a specific cost figure on that increase — however, during that same period, the Muni budget increased by one-third, from $149 million to $201 million. And the amount of General Fund money the city has had to put into the Muni system to make up for operating deficits rose by some 737 — from $59 million to $102 million.

The new buildings, of course, have meant new tax revenues — between 1981 and 1986, the total assessed value of San Francisco property — the city’s tax base — increased 767, from $20.3 billion to $35.8 billion. But the cost of servicing those buildings and their occupants also increased 437, from $1.3 billion to to $1.9 billion. In 1982, San Francisco had a healthy municipal budget surplus of $153 million; by this year, it was down to virtually nothing.

The city’s general obligation bond debt — the money borrowed to pay for capital improvements — has steadily declined over the past five years, largely because the 1978 Jarvis-Gann tax initiative effectively prevented cities from selling general obligation bonds. In 1982, the city owed $220 million; as of July 1st, 1987, the debt was down to $151 million.

However, under a recent change in the Jarvis-Gann law, the city can sell general obligation bonds with the approval of two-thirds of the voters. The first such bond sale — $31 million — was approved in June, and the bonds were sold this month, raising the city’s debt to $182 million. And this November, voters will be asked to approve another $95 million in bonds, bringing the total debt to $277 million, the highest level in five years.

The city’s financial health is still fairly sound; Standard and Poor’s gives San Francisco municipal bonds a AA rating, among the best of any city in the nation. And even with the new bonds, the ratio of general obligation debt to total assessed value — considered a key indicator of health, much as a debt-to-equity ratio is for a business — is improving.

But the city’s fiscal report card is decidedly mixed. For most residents, signs of the city’s declining financial health show up not in numbers on a ledger but in declining services. Buses are more crowded and run less often. Potholes aren’t fixed. On rainy days, raw sewage still empties into the Bay. High housing costs force more people onto the streets — and the overburdened Department of Social Services can’t afford to take care of all of them.

What those signs suggest is that, in its pell-mell rush to become the Manhattan of the West, San Francisco may have poisoned its quality of life — and thus damaged the very economic climate it was ostensibly trying to create.

MAYOR DIANNE FEINSTEIN’S prescription for San Francisco’s economic problems and her blueprint for its future can be summed up in four words: More of the same. Feinstein, like Wells Fargo, PG&E and the Chamber of Commerce, is looking to create jobs and generate city revenues from the top of the economy down. Her program flies in the face of modern economic reality and virtually ignores the changes that have taken place in the city in the past five years.

Feinstein’s most visible economic development priorities have taken her east, to Washington D.C., and west, to Japan and China. In Washington, Feinstein has lobbied hard to convince the Navy to base the battleship USS Missouri in San Francisco. That, she says, will bring millions of federal dollars to the city and create thousands of new jobs.

In Asia, Feinstein has sought to entice major investors and industries to look favorably on San Francisco. She has expressed hope that she will be able to attract several major Japanese companies to set up manufacturing facilities here, thus rebuilding the city’s manufacturing base and creating jobs for blue-collar workers.

Neither, of course, involves building new downtown highrises. But both are entirely consistent with the Pacific Rim strategy — and both will probably do the city a lot more harm than good.

Feinstein’s programs represent an economic theory which has dominated San Francisco policy-making since the end of World War II. In those days, the nation’s economy was based on manufacturing — iron ore from the ground became steel, which became cars, lawn mowers and refrigerators. Raw materials were plentiful and energy was cheap.

By the early 1970s, it was clear that era was coming to a close. Energy was suddenly scarce. Resources were becoming expensive. The economy began to shift gears, looking for ways to make products that used less materials and less energy yet provided the same service to the consumer.

Today, almost everyone has heard of the “information age” — in fact, the term gets used so often that it’s begun to lose its meaning. But it describes a very real phenomenon; Paul Hawken, the author of The Next Economy, calls it “ephemeralization.” What is means is that the U.S. economy is rapidly changing from one based manufacturing goods to one based on processing information and providing services. In the years ahead, the most important raw materials will be ideas; the goal of businesses will be to provide people with useful tools that require the least possible resources to make and the least possible energy to use.

In the information age, large companies will have no need to locate in a central downtown area. The source of new jobs will not be in manufacturing — giant industrial factories will become increasingly automated, or increasingly obsolete. The highways of the nation’s commerce will be telephone lines and microwave satellite communications, not railroads and waterways.

IF SAN FRANCISCO is going to be prepared for the staggering changes the next economy will bring, we might do well to take a lesson from history — to look at how cities have survived major economic changes in the past. Jane Jacobs, the urban economist and historian, suggests some basic criteria.

Cities that have survived and prospered, Jacobs writes, have built economies from the bottom up. They have relied on a large number of small, diverse enterprises, not a few gigantic ones. And they have encouraged business activities that use local resources to replace imports, instead of looking to the outside for capital investment.

A policy that would tie the city’s economic future to the Pentagon and Japanese manufacturing companies is not only out of synch with the future of the city’s economy — it’s out of touch with the present.

In San Francisco today, the only major economic good news comes from the small business sector — from locally owned independent companies with fewer than 20 employees. All of the net new jobs in the city since 1980 have come from such businesses.

Yet, the city’s policy makers — especially the mayor — have consistently denied that fact. As recently as 1985, Feinstein announced that the only reason the city’s economy was “lively and vibrant” was that major downtown corporations were creating 10,000 new jobs a year.

Almost nothing the city has done in the past ten years has been in the interest of small business. In fact, most small business leaders seem to agree that their astounding growth has come largely despite the city’s economic policy, not because of it. That situation shows no signs of changing under the Feinstein administration; the battleship Missouri alone would force the eviction of some 190 thriving small businesses from the Hunters Point shipyard.

San Francisco’s economic problems have not all been the result of city policies. The financial health of the city’s public and private sector is affected by state and federal policies and by national and international economic trends.

Bank of America, for example, is reeling from the inability of Third World countries to repay outstanding loans. Southern Pacific and Crocker National Bank both were victims of takeovers stemming from relaxed federal merger and antitrust policies. In fact, according to Wells Fargo, 21 San Francisco corporations have been bought or merged since 1975. Meanwhile, deep cutbacks in federal and state spending have crippled the city’s ability to repair its infrastructure, improve transit services, build low cost housing and provide other essential services.

To a great extent, those are factors outside the city’s control. They are unpredictable at best — and over the next ten or 20 years, as the nation enters farther into the Information Age, the economic changes with which the city will have to cope will be massive in scale and virtually impossible to predict accurately.

Again, the experiences of the past contain a lesson for the future. On of San Francisco’s main economic weaknesses over the past five years has been its excess reliance on a small number of large corporations in a limited industrial sector — largely finance, insurance and real estate. When those industries took a beating, the shock waves staggered San Francisco.

Meanwhile, the economic good news has come from a different type of business — businesses that were small able to adapt quickly to changes in the economy and numerous and diverse enough that a blow to one industry would not demolish a huge employment base.

But instead of using city policy to encourage that sector of the city’s economy, Feinstein is proposing to bring in more of the type of business that make the city heavily vulnerable to the inevitable economic shocks that will come with the changes of the next 20 years.

THE CANDIDATES who seek to lead the city into the next decade and the next economy will need thoughtful, innovative programs to keep San Francisco from suffering serious economic problems. Those programs should start with a good hard dose of economic reality — a willingness to understand where the city’s strengths and weaknesses are — mixed with a vision for where the city ought to be ten and 20 years down the road.

Thus far, both are largely missing form the mayoral debate.

For years, San Francisco activists and small business leaders have been complaining about the lack of reliable, up-to-date information on the city’s economy and demographics. The environmental impact report on the Downtown Plan — a program adopted in 1985 — was based largely on data collected in 1980. That same data is still used in EIRs prepared by the City Planning Department, and it’s now more than seven years out of date.

In many areas, even seven-year-old data is simply unavailable. Until the Bay Guardian commissioned the Birch studies in 1985 and 1986, the city had no idea where jobs were being created. Until SFRG commissioned the Sedway-Cooke report in 1985, no accurate data existed on the city’s labor pool and the job needs of San Franciscans.

Today, a researcher who wants to know how much of the city’s business tax revenue comes from small business would face a nearly impossible task. That’s just not available. Neither are figures on how much of the city’s residential or commercial property is owned by absentee landlords who live outside the city. If San Francisco were a country, what would its balance of trade be? Do we import more than we export? Without a huge research staff and six months of work, there is no way to answer those questions.

Bruce Lilienthal, chairman of the Mayor’s Small Business Advisory Commission, argues that the city needs to spend whatever money it takes to create a centralized computerized data base — fully accessable to the public — with which such information can be processed and analyzed.

A sound economic policy would combine that sort of information with a clear vision of what sort of city San Francisco could and should become.

What would a progressive, realistic economic development platform look like? We’ve put together a few suggestions that could serve as the outline for candidates who agree with our perspective — and as an agenda for debate for candidates who don’t.

* ADEQUATE AFFORDABLE HOUSING is essential to a healthy city economy, and in the Reagan Era, cities can’t count on federal subsidies to build publicly financed developments. Progressive housing experts around the country agree that, in a city under such intense pressure as San Francisco, building new housing to keep pace with demand will not solve the crisis alone; the city needs to take action to ensure that existing housing is not driven out of the affordable range.

Economist Derek Shearer, a professor at Occidental College in Los Angeles and a former Santa Monica planning commissioner, suggests that municipalities should treat housing as a scarce public resource, and regulate it as a public utility. Rents should be controlled to allow property owners an adequate return on their investment but prevent speculative price-gouging.

Ideally, new housing — and whenever possible, existing housing — should be taken out of the private sector altogether. Traditional government housing projects have had a poor record; a better alternative is to put housing in what is commonly called a land trust.

A land trust is a private, nonprofit corporation that owns property, but allows that property to be used under certain terms and conditions. A housing trust, for example, might allow an individual or family to occupy a home or apartment at a set monthly rate, and to exercise all rights normally vested in a homeowner — except the right to sell for profit. When the occupant voluntarily vacated the property, it would revert back to the trust, and be given to another occupant. The monthly fee would be set so as to retire the cost of building the property over it’s expected life — say, 50 years. Each new occupant would thus not have to pay the interest costs on a new mortgage. That alone, experts say, could cut as much as 707 off the cost of a home or apartment.

* DEVELOPMENT DECISIONS should be made on the basis of community needs. A developer who promises to provide jobs for San Franciscans should first be required to demonstrate that the jobs offered by project will meet the needs of unemployed residents of the city. Development fees and taxes should fully and accurately reflect the additional costs the project places on city services and infrastructure.

Land use and development decisions should also be geared toward meeting the needs of small, locally owned businesses — encouraging new start-ups and aiding the expansion of existing small firms.

* ECONOMIC DEVELOPMENT programs should encourage local firms to use local resources in developing products and services that bring revenue and wealth into the city instead of sending it to outside absentee owners and that encourage economic self-sufficiency.

Cities have a wide variety of options in pursuing this sort of goal. City contracts, for example, should whenever possible favor locally owned firms and firms that employ local residents and use local resources. Instead of just encouraging sculptured towers and flagpoles on buildings, city planning policies should encourage solar panels that decrease energy imports, rooftop gardens that cut down on food imports and utilize recycled materials that otherwise would become part of the city’s garbage problem. (Using recycled materials is by no means a trivial option; if all of the aluminum thrown away each year in San Francisco were recycled, it would produce more usable aluminum than a small-to-medium sized bauxite mine.)

Other cities have found numerous ways to use creative city policies to encourage local enterprise. In Minneapolis-St. Paul, for example an economic development agency asked the U.S. Patent Office for a list of all the patents issued in the past ten years to people with addresses in the Twin Cities area. The agency contacted those people — there were about 20 — and found that all but one had never made commercial use of the patents, largely for lack of resources. With the agency as a limited partner providing venture capital, more than half the patent owners started businesses that were still growing and expanding five years later. Some of those firms had actually outgrown their urban locations and moved to larger facilities out of town — but since the Twin Cities public development agency had provided the venture capital, it remained a limited partner and the public treasury continued to reap benefits from the profits of the businesses that had left town.

* CITY RESOURCES should be used to maximize budget revenues. For example, San Francisco currently owns a major hydroelectric power generating facility at Hetch Hetchy in Yosemite National Park. A federal law still on the books requires San Francisco to use that facility to generate low-cost public power for its citizens; that law, the Raker Act, has been honored only in the breach. That means every year PG&E takes millions of dollars in profits out of San Francisco (the company is based here, but very few of its major stockholders are San Franciscans). The last time we checked, San Francisco was losing $150 million (CHECK) in city revenue by failing to enforce the Raker Act and municipalize its electric utility system.

Meanwhile, PG&E continues to use city streets and public right-of-ways for its transmission cables at a bargain-basement franchise fee passes in 1932 and never seriously challenged. Other highly profitable private entities, like Viacom cable television, use public property for private purposes and pay highly favorable rates for the right.

Those ideas should be the a starting point, not a conclusion for mayoral debates. But thus far, we’ve seen precious little consideration of the issues, much less concrete solutions, from any of the candidates.

The mayor’s race, however, is still very much open, and the candidates are sensitive to public opinion. If the voters let the candidates know that we want to hear their visions of the city’s economic future — and their plans for carrying those visions out — we may see some productive and useful discussions yet.*
