EDITORIAL Not long after the US Army announced it no longer needed the Presidio for a military base, a group of powerful San Francisco business leaders began eyeing what would become the first privatized national park in America. Among the businesses aiming to grab a piece of the immensely valuable real estate were Pacific Gas and Electric Co. and Transamerica Corp.; among the individuals was the founder of the Gap, a Republican named Don Fisher.
Fisher helped thenUS representative Nancy Pelosi pull off an astonishing feat: she took more than 1,200 acres of land earmarked by federal law as a national park and handed it over to real estate developers (see "Stolen Base," 5/8/96). Fisher, who became one of the first members of the private board that manages the Presidio, was around to help George Lucas build a massive business park on the site and pick up a $60 million tax break in the process.
Now Fisher, who along with his billions has amassed a pretty impressive collection of contemporary art, wants to build a gigantic private museum right in the heart of the park, at the site of the old post. His plan would drop a 100,000-square-foot Battlestar Galactica on the old parade grounds, wiping out a sizable amount of open space. The museum would be on public land, but he’d run it himself, in his own way, with no public oversight.
This is a terrible idea, and San Franciscans ought to be up in arms about it.
According to reports in the San Francisco Chronicle, Fisher has been looking for some time for a way to display his art collection, and he has talked to people at the existing big museums, the Museum of Modern Art and the de Young. But those talks broke down in part, we’re told by sources, because Fisher didn’t want the professional curators and museum directors calling any shots. He wanted complete control over the art control over where it was hung, when it was displayed, who got to see it, etc. The folks who run those cultural institutions are too polite to say so in public, but they don’t generally go for that sort of demand. So Fisher did what billionaires around the country are starting to do: he decided to build his own museum.
That’s his right, of course, and if he’d sought a spot, say, South of Market near SFMOMA, it might not be a bad thing. But the Presidio is entirely the wrong place for this sort of institution.
For starters, there’s no easy way to get there. Transit to the main post at the Presidio is very limited one Muni line, which runs infrequently. No BART, no light rail nothing of the sort of access you would want for a major public attraction. Car access is through the crowded Marina neighborhood, and the museum would no doubt build a huge parking garage, meaning the park and the surrounding areas would be inundated with cars. That alone would be a violation of the spirit of all the nation’s parks, which are trying desperately to reduce the number of car visits. There are no other cultural attractions around, so visitor traffic to Fisher’s museum would have no spillover benefits for any other museums.
And he’s talking about a whopper of a structure. There’s no way to gently insert a building that big into the park; it can’t blend in with the existing structures or the natural scenery. It’s just going to stick out like a bloated, gangrenous sore thumb, ruining the view and the historical nature of the area.
The private Presidio Trust has sole discretion over the proposal, but city officials can speak up, loudly. The Board of Supervisors should pass a resolution opposing the museum, the arts community should demand that it be relocated, and the public at large ought to tell the trust and Fisher that his personal memorial edifice isn’t welcome in the park.*
CHEAP EATS First windmills we saw were in Wyoming, and I was in the back of the van writing about Don Quixote. So that was cool. I like stuff like that. Then in Nebraska it was my turn to drive and we went through a tornado. It was just getting dark out, and at first this was amazing. Lightning was everywhere all at once not just bolts but balls and flowers and roadmaps. Explosions of pure pyromania, like fireworks or a war zone. One of the most beautiful things I’ve ever seen.
I was in the van by myself. For a while we had two cars, and Phenomenon was in the other one with Fiddlesticks and our fearless leader, Chief. So they had all the bravery with them, but I had the snacks.
The van goes like a boat in the wind. I was giggling and hooting, scanning my music for something to live up to the light show. I had snacks and iTunes. When a speed limit sign twisted out of the ground and flew away, things changed for me and I very immediately had back problems. Neck. Shoulders. If I lived, I was going to need a massage.
Besides bravery, the other car had all of our toll money and leadership skills, but for some reason me and snacks were calling the shots. So long as I didn’t see any actual twisters, and I didn’t, my strategy, now that we were in it, was to just keep driving. The lightning was indistinguishable from the thunder, or anything else. Everything was just light and noise, rain and us, all rolled up and rolling. My knuckles hurt.
Drive, drive, drive, drive, drive, and then right when we’d finally outrun the mayhem, my fuel light came on. I got off at the next exit and gassed up, sirens whooping from all the nearby Nebraska towns and the wind whipping plastic cup can lids around my ankles. The food mart woman was standing in the doorway of the store saying, "Tornado."
"Which way’s it coming?" I asked.
"From the west," she said. Like us, meaning: my massage would have to wait. Not wanting to tempt the tempest, we skedaddled. We dragged that weather system all the way across Nebraska and never got wet.
I ate some wonderful food in Youngstown, Ohio, of all the crazy places. My hometown. We played outside in an alley at this café called Selah, and they fed me ricotta gnocchi with fresh spinach and cream sauce that was as good as any gnocchi I’ve eaten in any San Francisco restaurant. So I take back everything I ever said about my old hometown.
Even though technically Selah is in Struthers.
And then this morning I woke up in my other old hometown, Portsmouth, N.H., where I ate brick oven pizza that rivaled Tomasso’s and top-notch carne asada burritos across the river in Kittery, Maine (of all the other crazy places). Loco Coco or Coco Loco. Southern California transplants, I believe, but they do put rice in their burritos, and I’d just as soon have another one of those than anything I can think of in the Mission.
I’m not saying all this to dis my city. It’s more like: Hey, look at this! Or: Wish you were here. It’s a postcard. And I do wish you were here, and also wish I were there, instead of in the back of a van spinning down the East Coast now, Earl Butter at the wheel, Phenomenon all neck-cricked next to him, drooling into his western shirt.
We lost our fiddler and our chief, Chief, and picked up Mr. Butter, who is rapidly becoming every old person’s favorite young person. On the other hand, he’s not entirely certain he’s a licensed driver anymore. And he’s driving. I backed into a deck a couple days ago and sharded our back window into all our gear and sleeping stuff. Now we’re counting on plastic and duct tape to keep our stuff in and the weather out.
After seven shows in three days in Bangor, Maine, I’d had it up to here with outrageous friendliness, mosquitoes, and "King of the Road."
If all goes as planned, tomorrow we will wake up near an unpronounceable, unspellable tidal river in Rhode Island, and we’re going to rake for clams and hopefully have some homemade chowder for breakfast.
Then: Providence. Then: Albany, N.Y. Then: Bikkets’s wedding, and then, old folks be damned, we start sallying slowly back to home-sweet-home and my new favorite restaurant. *
Oaxaca, Mexico Those of us who report from the front lines of the social-justice movement in Latin America share an understanding that there’s always a bullet out there with our name on it. Brad Will traveled 2,500 miles, from New York to this violence-torn Mexican town, to find his.
Throughout the summer and fall of 2006, the southern Mexican state of Oaxaca was on fire. Death squads, the pistoleros of a despised governor, rolled through the cobblestoned streets of this colonial capital, peppering with automatic weapon fire the flimsy barricades erected by masked rebels. Hundreds were killed, wounded, or imprisoned.
Will, a New York Indymedia videojournalist, felt he had to be there. Xenophobia was palpable on the ground when Will touched down. Foreign journalists were attacked as terrorists by the governor’s sycophants in the media: "Si ves un gringo con cámara, matanlo!" the radio chattered if you see a gringo with a camera, kill him!
For much of the afternoon of Oct. 27, Will had been filming armed confrontations on the barricades just outside the city. He was trapped in the middle of a narrow street while gunshots boomed all around him, but he kept filming, looking for the money shot.
And he found it: on his final bits of tape, two clearly identifiable killers are perfectly framed, their guns firing. You hear the fatal shot and experience Brad’s shudder of dismay as the camera finally tumbles from his hands and bounces along the sidewalk.
By all visible evidence, Brad Will filmed his own murder. But this is Mexico, where justice is spelled impunity and Will’s apparent killers continue to ride the streets of Oaxaca, free and, it seems, untouchable.
Curiously, this egregious murder of a US reporter in Mexico has drawn minimal response from US Ambassador Tony Garza, an old crony of President George W. Bush. Why this lack of interest? Can it be that Washington has another agenda that conflicts with justice for Will the impending privatization of Mexican oil?
HEADING SOUTH
Will was once a fire-breathing urban legend on Manhattan’s Lower East Side. Whether perched atop the Fifth Street squat where he had lived for years and waving his long arms like Big Bird as the wrecking ball swung in, or being dragged out of City Hall dressed as a sunflower while trying to rescue the neighborhood’s community gardens, this child of privilege from Chicago’s wealthy North Shore was a legitimate street hero in the years before the World Trade Center towers collapsed and the social-change movement in New York City went into deep freeze.
Will hosted an incendiary weekly show on the New York pirate station Steal This Radio and was an early part of Indymedia, the Web publishing experiment born during the "Battle of Seattle," the World Trade Organization protests that rocked that city in 1999.
With his long hair neatly tied back and parted down the middle, with his granny glasses and fringe beard, and with his fierce commitment to building community, Will seemed to have emerged whole from a more utopian time in America.
He was an independent journalist, one of the growing number of people, such as Josh Wolf in San Francisco, who use the Internet and their video cameras to track and report on social moments and injustice. He wore no credential from any major news organization. But using outlets like Indymedia, he like Wolf, who spent seven months in prison to avoid giving the police a copy of his video outtakes represented part of the future of journalism.
Will’s journey to the land where he would die began right after Sept. 11, 2001. Dyan Neary, then a neophyte journalist, met Will in a South Street skyscraper elevator coming down from the WBAI studios from which Amy Goodman broadcast soon after the terrorist attacks.
"We walked down the piles. They were still smoking," Neary remembered in a phone call from Humboldt County. "We were both really scared. We thought this was not going to be resolved soon. Maybe never. So we thought we should go to Latin America, where people were still fighting."
Will and Neary spent most of 2002 and 2003 roaming the bubbling social landscape of Latin America. In Fortaleza, Brazil, they confronted the director of the Inter-American Development Bank during riotous street protests. They journeyed to Bolivia too and interviewed Evo Morales, not yet the president. They traveled in the Chapare rainforest province with members of the coca growers’ federation. They hung out in Cochabamba with Oscar Olivera, the hero of the battle to keep Bechtel Corp. from taking over that city’s water system. Everywhere they went, they sought out pirate radio projects and offered their support.
In February 2005, Will was in Brazil, in the thick of social upheaval, filming the resistance of 12,000 squatters at a camp near the city of Goiânia in Pernambuco state, when the military police swept in, killing two and jailing hundreds. On his videos, you can hear the shots zinging all around him as he captured the carnage. Will was savagely beaten and held by the police. Only his US passport saved him.
Undaunted by his close call, Will picked up his camera and soldiered back through Peru and Bolivia, and when the money ran out, he flew back to New York to figure out how to raise enough for the next trip south. He was hooked. In early 2006, drawn like a moth to flame, he was back, tracking Subcomandante Marcos and the Zapatistas’ Other Campaign through the Mayan villages on Mexico’s Yucatán Peninsula.
In the spring of 2006, Will was back in New York as he tracked the Other Campaign and the incipient rebellion in Oaxaca on the Internet from his room in Williamsburg. (The rent gougers had forced him out of the Lower East Side.) He was poised to jump south again, friends say, but was worried that he would just be one more white guy getting in the way.
In the end, the lure of the action in Oaxaca pulled him in. He bought a 30-day ticket, caught the airport shuttle from Brooklyn to John F. Kennedy International Airport, and flew south Sept. 29. His return was set for Oct. 28. He never made that flight.
THE COMMUNE OF OAXACA
A mountainous southern Mexican state traversed by seven serious sierras, Oaxaca is at the top of most of the nation’s poverty indicators infant mortality, malnutrition, unemployment, and illiteracy. Human rights violations are rife. It’s also Mexico’s most indigenous state, with 17 distinct Indian cultures, each with a rich tradition of resistance to the dominant white and mestizo overclass. Oaxaca vibrates with class and race tensions that cyclically erupt into uprising and repression.
The Party of the Institutional Revolution, or PRI, ruled Mexico from 1928 to 2000, the longest-running political dynasty in the world. The corrupt organization was dethroned by the right-wing National Action Party (PAN) and its picaresque presidential candidate, Vicente Fox, former president of Coca Cola México.
But in Oaxaca, the PRI never lost power. While voters were throwing off the PRI yoke all over the rest of the country, in Oaxaca one PRI governor had followed another for 75 years. The latest, Ulises Ruiz Ortiz, a protégé of party strongman and future presidential candidate Roberto Madrazo, won a fraud-marred election over a right-left coalition in 2004.
In the first 16 months of his regime, Ruiz proved spectacularly unresponsive to the demands of the popular movements for social justice. When, on May 15, 2006, National Teachers Day, a maverick, militant local of the National Education Workers Union known as Section 22 presented its contract demands, Ruiz turned a deaf ear. Then, on May 22, tens of thousands of teachers took the plaza and 52 surrounding blocks and set up a ragtag tent city. Each morning the maestros would march out of their camp and block highways and government buildings, which were soon smeared with anti-Ruiz slogans.
Ruiz retaliated before dawn June 14, sending 1,000 heavily armed police officers into the plaza to evict the teachers. Low-flying helicopters sprayed pepper gas on the throng below. Ruiz’s police took up positions in the colonial hotels that surround the plaza and tossed down concussion grenades from the balconies. Radio Plantón, the maestros’ pirate radio station, was demolished and the tent city set afire. A pall of black smoke hung over the city.
Four hours later a spontaneous outburst by Oaxaca’s very active community, combined with the force of the striking teachers and armed with clubs and Molotov cocktails, overran the plaza and sent Ruiz’s cops packing. No uniformed officers would be seen on the streets of Oaxaca for many months. And on June 16, two days after the monumental battle, 200,000 Oaxacans marched through the city to repudiate the governor’s "hard hand." The megamarch was said to extend 10 kilometers.
John Gibler, who closely covered the Oaxaca uprising as a human-rights fellow for Global Exchange, wrote that the surge of the rebels June 14 soon transformed itself into a popular assembly. The Oaxaca Peoples Popular Assembly, or APPO, was formally constituted June 21. The APPO had no leaders but many spokespeople, and all decisions had to be made in assemblies.
A CITY PARALYZED
For the next weeks, the actions of the APPO and Section 22 paralyzed Oaxaca but the rest of Mexico took little notice. Instead, the nation was hypnotized by the fraud-marred July 2 presidential election in which a right-wing PAN-ista, Felipe Calderón, had been awarded a narrow victory over leftist Andrés Manuel López Obrador, the candidate of a coalition headed by the Party of the Democratic Revolution. López Obrador was quick to cry fraud, pulling millions into the streets in the most massive political demonstrations in Mexican history. Oaxaca still seemed like small potatoes.
But Oaxaca is an international tourist destination, and the APPO and Section 22 protests had closed down the tourist infrastructure, blocking the airport and forcing five-star hotels to shutter their doors. On July 17, Ruiz was forced to announce the cancellation of the Guelaguetza, an indigenous dance festival that has become Oaxaca’s premiere tourist attraction, after roaming bands of rebels destroyed the scenery and blockaded access to the city.
Ruiz began to fight back. By the first weeks of August, the governor launched what came to be known as the Caravan of Death a train of 30 or 40 private and government vehicles rolling nightly, firing on the protesters. Ruiz’s gunmen were drawn from the ranks of the city police and the state ministerial police.
To keep the Caravan of Death from moving freely through Oaxaca, the APPO and the union threw up barricades; 1,000 were built in the working-class colonies throughout the city and its suburbs. The rebels piled up dead trees, old tires, and burned-out cars and buses to create the barricades, which soon took on a life of their own; murals were painted using the ashes of the bonfires that burned all night on the barriers. Indeed, the barricades gave the Oaxaca struggle the romantic aura of the Paris Commune uprising of 1871 and attracted droves of dreadlocked anarchists to the city.
An uneasy lull in the action gripped Oaxaca on Oct. 1, when Will arrived at the bus terminal, then found himself a cheap room for the night. The break wouldn’t last long.
ON THE BARRICADES
Like most non-Mexicans who style themselves as independent reporters, Will had no Mexican media credential and therefore was in the country illegally, working on a tourist visa and susceptible to deportation. To have some credential other than his Indymedia press card to hang around his neck, he got himself accredited with Section 22 and wore the rebel ID assiduously.
On Oct. 14, APPO militant Alejandro García Hernández was cut down at a barricade near Símbolos Patrios, a downtown plaza. Will joined an angry procession to the Red Cross hospital where the dead man had been taken.
In the last dispatch he filed from Oaxaca, on Oct. 16, Will caught this very Mexican whiff of death: "Now [García Hernández lies] waiting for November when he can sit with his loved ones on the day of the dead and share food and drink and a song … one more death one more martyr in a dirty war one more time to cry and hurt one more time to know power and its ugly head one more bullet cracks the night."
The dynamic in Oaxaca had gotten "sketchy," Will wrote to Neary. Section 22 leader Enrique Rueda Pacheco had cut a deal with the outgoing Fox government and forced a back-to-work vote Oct. 21 that narrowly carried amid charges of sellout and payoffs. If the teachers went back to work, the APPO would be alone on the barricades and even more vulnerable to Ruiz’s gunmen. But backing down was not in the assembly’s dictionary, and the APPO voted to ratchet up the lucha (struggle) and make Oaxaca really ungovernable.
Mobile brigades were formed young toughs armed with lead pipes and nail-studded boards who hijacked buses still running in the city, forced the passengers off, and rode around looking for action. Later the buses would be set afire. Charred hulks blossomed on the streets of the old colonial city. The barricades were reinforced to shut down the capital beginning Oct. 27.
The escalation proved to be a terrible miscalculation. In Mexico City the postelectoral turmoil had finally subsided, and PAN was ready to deal with the PRI; bailing out the governor of Oaxaca was the PRI’s price of admission.
It wasn’t a good time for inexperienced foreigners. Ruiz’s people were checking the guest lists at the hostels for "inconvenient" internationals. Immigration authorities threatened extranjeros with deportation if they joined the protests. The local US consul, Mark Leyes, warned Americans that he would not be able to help them if they got caught up in the maelstrom.
Adding to this malevolent ambiance, a new pirate station popped up Oct. 26. Radio Ciudadana (Citizens’ radio) announced it was broadcasting "to bring peace to Oaxaca" and to celebrate the honor of "our macho, very macho governor." The announcers seemed to have Mexico City accents. Wherever they had been sent from, they let loose with a torrent of vitriolic shit stuff like "We have to kill the mugrosos [dirty ones] on the barricades." The extranjeros, the radio said, were stirring up all the trouble: "They pretend to be journalists, but they have come to teach terrorism classes."
More frightening was this admonition: "Si ves un gringo con cámara, matanlo!" "If you see a gringo with a camera, kill him!"
This poison spewed out of local radios all day Oct. 26 and 27, but whether Will heard the warnings and if he did, whether knew what they meant is unclear. He didn’t speak much Spanish.
SHOT IN THE CHEST
On Oct. 27, Will went out to do interviews on the barricade at Santa María Coyotepec, about 20 kilometers from the city. The three barricades at Coyotepec, Cal y Canto, and La Experimental were crucial to closing down Oaxaca the next day. The broad Railroad Avenue where the barricade was stacked was empty. Nothing was moving. Will walked on to the next barricade at La Experimental to check out the action.
Soon after the Indymedia reporter left, all hell broke loose at Cal y Canto. A mob of about 150 Ruiz supporters stormed down Railroad Avenue, led by what witnesses thought was a Chevy Blazer. The vehicle was moving very fast. "We thought it would try and crash through the barricade," Miguel Cruz, an activist and witness, recalled. But the SUV stopped short, and several men jumped out with guns blazing. The APPO people hunkered down behind the makeshift barrier and moved the women and kids who were with them into a nearby house. Then they went on the counterattack with Molotov cocktails, homemade bazookas that fired bottle rockets, and slingshots. Most of the mob had melted away, and with the gunmen retreating, the rebels torched their vehicle.
Will heard about the gunfire and hurried back to Cal y Canto with a handful of other reporters. They arrived a little after 3 p.m.
Will climbed under a parked trailer to film the shooters. He focused on a man in a white shirt. When an APPO activist (who is not seen on the videotape) came running by, Will indicated the shooter "Camisa blanca." While all this was going on, the camera captured a bicyclist peddling dreamily through the intersection. Soon after, a large dump truck appeared on the scene, and the group on the barricade used it as a mobile shield as they chased the gunmen down the avenue.
Suddenly, the pistoleros veered down a narrow side street, Benito Juárez, and took refuge in a windowless, one-story building on the second block. The only access to the building was through a large metal garage door, and the reporters followed the APPO militants, many of whom were masked, as they tried to force their way in. Will stood to one side of the door for a minute, poised for the money shot. Then the compas tried unsuccessfully to bust down the big door by ramming the dump truck into it.
In the midst of this frenzy, five men in civilian dress two in red shirts (the governor’s color) and the others in white appeared at the head of Benito Juárez, about 30 meters away, and began shooting at the rebels.
Two of the gunmen were later identified by Mexican news media as Pedro Carmona, a cop and local PRI political fixer, and police commander Orlando Manuel Aguilar Coello. One of those in the white shirts, crouched behind Carmona, was Abel Santiago Zárate, a.k.a. El Chino. Santiago Zárate and Aguilar Coello were reported to be the personal bodyguards of municipal president Manuel Martínez Feria of the PRI. The other two would later be fingered as Juan Carlos Soriano, a.k.a. El Chapulín (the grasshopper), and Juan Sumano, both Santa Lucía del Camino police officers. All five are eminently identifiable in the film Will shot just moments before the bullets hit him.
When the shooting erupted, Will took cover on the opposite side of the narrow street from the rest of the media. He was crouched against a lime green wall when the first bullet came. On the video soundtrack, you can hear both the shot and Will’s cries of dismay as it tore through his Indymedia T-shirt and smashed into his heart. A second shot caught him in the right side and destroyed his innards. There was little blood spilled, the first slug having stopped his heart.
In footage that witness Gustavo Vilchis and others filmed, the entrance wound of the first shot looks like a deep bruise. The second shot was not recorded on the soundtrack and may have been fired simultaneously with the first.
Others were shot in the pandemonium. Oswaldo Ramírez, filming for the daily Milenio, was grazed. Lucio David Cruz, described as a bystander, was hit in the neck and died four months later.
As Will slid down the wall into a sitting position, Vilchis and activist Leonardo Ortiz ran to him. Will’s Section 22 credential had flown off, and no one there knew his name. With bullets whizzing by, the compas picked Will up and dragged him out of the line of fire and around the corner to Árboles Street, about 35 paces away. Along the way, his pants fell off.
"Ambulance! We need an ambulance! They’ve shot a journalist!" Vilchis, a tall young man with a face like an Italian comic actor’s, shouted desperately. Gualberto Francisco, another activist, had parked his vochito (Volkswagen Bug) on Árboles and pulled up alongside Will, who was laid out on the pavement in his black bikini underwear.
Ortiz and Vilchis loaded the dying Will into the back seat. They thought he was still breathing, and Vilchis applied mouth-to-mouth resuscitation. "You’re going to make it … you’re all right," they kept telling him. But Will’s eyes had already turned up he was perdido (lost), as they say in Mexico.
The vochito ran out of gas, and while the frantic young men ferrying Will were stuck in the middle of the Cinco Señores crossroad, it began to rain hard. They tried to stop a taxi to take them to the Red Cross, but the driver supported the government and wanted to argue. Finally, they flagged down a pickup truck and laid Will out in the bed. He was dead when he arrived at the hospital, according to the report by the coroner, Dr. Luis Mendoza.
THE OUTRAGE BEGINS
Oct. 27 was the bloodiest day of the Oaxaca uprising. Four people were killed besides Will: Emilio Alonso Fabián, Esteban Ruiz, Esteban López Zurita, and Audacia Olivera Díaz.
Unlike their murders, Will’s death triggered international outrage. Because he was so connected and because much of the episode was recorded on film the shot of the mortally wounded Indymedia reporter lying in the middle of a Oaxaca street went worldwide on the Web in a matter of minutes.
There were instant vigils on both coasts of the United States. On Oct. 30, 11 of Will’s friends were busted trying to lock down at the Mexican consulate off Manhattan’s Park Avenue, where graffiti still read "Avenge Brad!" in December. Anarchists splattered the San Francisco consulate with red paint. Subcomandante Marcos sent his condolences and called for international protests. Goodman did an hour-long memorial.
On March 16, 2007, at its midyear meeting in Cartagena de Indias, Colombia, the Inter-American Press Association, an organization devoted to freedom of speech and the press in the Americas, passed a resolution calling for action on the Will case.
"The investigation into the killing has been plagued by irregularities and inconsistencies, and no arrests have been made," the group said in a statement. IAPA called for the federal attorney general to take over the investigation, "in view of the lack of confidence in state authorities and the lack of progress in the case, so that it may apprehend the culprits, who, according to one theory of the investigation, may be indirectly linked to state authorities."
The official reaction to Will’s death was more cautious. "It is unfortunate when peaceful demonstrations get out of hand and result in violence," a US spokesperson told the media, seeming to blame the APPO for Will’s killing. After once again warning Americans that they traveled to Oaxaca "at their own risk," Ambassador Garza commented on the "senseless death of Brad Will" and how it "underscores the need for a return to the rule of law and order."
"For months," he said, "violence and disorder in Oaxaca have worsened. Teachers, students, and other groups have been involved in increasingly violent demonstrations."
Garza’s statement sent Fox the signal he had been waiting for. Now that a gringo had been killed, it was time to act. The next morning, Oct. 28, 4,500 officers from the Federal Preventative Police, an elite force drawn from the military, were sent into Oaxaca not to return the state to a place where human rights, dignity, and a free media are respected but to break the back of the people’s rebellion and keep Ruiz in power.
On Oct. 29 the troops pushed their way into the plaza despite massive but passive resistance by activists, tore down the barricades, and drove the commune of Oaxaca back into the shadows.
In Mexico the dead are buried quickly. After the obligatory autopsy, Brad’s body was crated up for shipment to his parents, who now live south of Milwaukee. After a private viewing, the family had him cremated.
SHAM ACCOUNTABILITY
Killing a gringo reporter in plain view of the cameras (one of which was his own) requires a little sham accountability. On Oct. 29 the state prosecutor, Lizbeth Caña Cadeza, announced that arrest warrants were being sworn out for Santiago Zárate and Aguilar Coello, two of the five cops caught on film gunning Will down, and they were subsequently taken into custody.
The scam lost currency two weeks later when, on Nov. 15, Caña Cadeza dropped a bombshell at an evening news conference: the cops hadn’t killed Will, she said; he was shot by the rebels.
Will’s death, she insisted, had been "a deceitful confabulation to internationalize the conflict" and was, in fact, "the product of a concerted premeditated action." The mortal shot had been fired from less than two and a half meters away, Caña Cadeza said although there is nothing in the coroner’s report to indicate this. The real killers, she said, were "the same group [Will] was accompanying."
In the state prosecutor’s scenario, the order of the shots was reversed: first Will had been shot in the side on the street, then rematado (finished off) with a slug to the heart on the way to the hospital in Francisco’s vochito.
The prosecutor’s plot was immediately challenged by the APPO. "The killers are those who are shown in the film," Florentino López, the assembly’s main spokesperson, asserted at a meeting that night.
And in fact our detailed investigation shows that there is very little evidence to support Caña Cadeza’s theory. Photos from the scene, some published in the Mexican media, show Will’s body with a bloody hole in his chest on the street near where he fell indicating that his fatal heart wound occurred well before he was dragged into the car where he was supposedly shot.
There’s another problem with the prosecutor’s suggestion: nobody on the scene saw any APPO members, or anyone except the authorities, carrying guns. This reporter has talked to numerous eyewitnesses, and all told the same tale: the rebels at the barricade that day had no firearms with which they could have shot Will.
Miguel Cruz, who spent much of Oct. 27 with Will, first at the Council of Indigenous People of Oaxaca, of which he is a member, and then on the barricade at Cal y Canto and on Juárez Street, is a soft-spoken young Zapotec Indian, but he pounded vehemently on the kitchen table when he addressed Caña Cadeza’s allegations.
"The compañeros had no guns. What gun is she talking about? They had slingshots and Molotovs but no guns. The PRI-istas and the cops had their .38s, and they were shooting at us," he said. "We were trying to save Brad Will’s life, not to kill him."
And if Caña Cadeza had any proof of her allegations, she likely would have filed charges. But none of the protesters or Will’s companions has been formally charged with the killing. Prosecutors have never publicly presented the alleged murder weapon.
But by the time Caña Cadeza told her story, of course, the only way to determine for sure the order of the bullets and the distance from which they had been fired would have been to exhume Will’s body. And there was no body; he had been cremated the week before.
On Nov. 28, Santiago Zárate and Aguilar Coello were released from custody by Judge Victoriano Barroso because of "insufficient evidence," with the stipulation that they could not be rearrested without the presentation of new evidence.
Caña Cadeza, who is now running as a PRI candidate for the state legislature, collaborated closely on the case with Oaxaca secretary of citizen protection Lino Celaya. Both reported to Ruiz’s secretary of government, Heliodoro Díaz, who in turn reported directly to the governor. There seems little doubt that the prosecutor’s accusations of murder against Will’s comrades and the determination of innocence for the apparent killers came straight from the top.
ON THE EVIDENCE TRAIL
Dr. Mendoza was occupied when I stopped by the Oaxaca city morgue to ask for a copy of the autopsy report on which the state has based its allegations.
"Will died eight months ago," Mendoza complained testily. "Do you know how many others have died since? How many autopsies I’ve performed?" He gestured to a morgue room where cadavers were piled up.
The coroner was scrunched over his desk, filling out the paperwork for one of the dead. He didn’t have any time to look for the autopsy report. I was not the first reporter to ask him about the document. "What paper are you from anyway?" he asked suspiciously, and when I showed him my media card, he told me that it didn’t sound like a real newspaper to him. "I know what I’m doing. I worked as a coroner in your country," he snapped defensively and waved me out of the office.
But Mendoza might not be quite as cocksure as he sounded. A senior agent for the US government in Oaxaca, who asked not to be named in this article, told me later that Mendoza confided to him that he was no ballistics expert, nor could he determine from how far away the bullets were fired.
I walked into the police commissary under the first-floor stairs of the Santa Lucía del Camino Municipal Palace. The small room was crowded with cops and cigarette smoke. Three of the officers were in full battle gear, and the rest were plainclothes. I had been warned not to ask for Carmona, the most prominent red shirt on Will’s film. Carmona is described as a prepotente i.e., a thug with an attitude who is always packing.
Instead, I asked the desk clerk if I could get a few minutes with Santiago Zárate and Aguilar Coello. For all I knew, the two were sitting in the room behind me. The desk clerk studied my card. "Qué lástima!" he exclaimed what a shame. Santiago Zárate had just left and wouldn’t be back until after six. Aguilar Coello was off that day. When I called back after six, Santiago Zárate was still not available. Nor were he and Aguilar Coello ever available the dozen or so times I called back.
This sort of stonewalling is not terribly unusual for Mexico, where killer cops often sell their services to local caciques (political bosses) and go back to work as if nothing had happened. Those who direct this sort of mayhem from their desks in the statehouses and municipal palaces the "intellectual assassins," as they are called are never held accountable for their crimes.
A VISIT FROM HOME
In March, Brad’s parents, Kathy and Howard Will, and his older brother and sister paid a sad, inconclusive visit to Oaxaca. They had hired Miguel Ángel de los Santos Cruz, a crackerjack human rights lawyer who has often defended Zapatista communities in Chiapas. Gibler, the Global Exchange human-rights fellow, was the translator.
The Wills, upper-middle-class Americans, had little experience with the kind of evil that lurks inside the Mexican justice system; the trip was a traumatic, eye-opening experience.
The federal Attorney General’s Office had taken over the case from the state in December, but rather than investigating police complicity and culpability, it was pursuing Caña Cadeza’s dubious allegation blaming Will’s companions for his killing.
Gustavo Vilchis, Gualberto Francisco, Leonardo Ortiz, and Miguel Cruz were summoned to give testimony, with the Wills in attendance. Testifying was a risky venture, as the witnesses could have been charged with the murder at any moment, but out of respect for the family, the compas agreed to tell their story to the federal investigators. During the hearing they were repeatedly questioned about and asked to identify not the cops who appear on Will’s film but their own compañeros, some masked, who appeared on tape shot by Televisa, the Mexican TV giant. They refused.
When Los Santos accompanied the Wills to a meeting with Caña Cadeza, she touted her investigation and promised them a copy of its results. But she refused to allow the family to view Will’s Indymedia T-shirt and the two bullets taken from his body. They were, she explained, under the control of Barroso the judge who had cut loose the cops.
THE POLITICS OF OIL
There are larger geopolitics at work here.
The US Department of State has a certain conflict of interest in trying to push first-year Mexican president Calderón to collar Will’s killers. The crackdown in Oaxaca was all about a political deal between Calderón’s PAN and Ruiz’s PRI: if PAN saved the governor’s ass, the PRI would support the president’s legislative package.
Indeed, the PRI’s 100 votes in the lower house of the Mexican Congress guarantee Calderón the two-thirds majority he needs to alter the constitution and effect the change that’s at the top of his legislative agenda opening up Petróleos Mexicanos, or PEMEX, the nationalized petroleum corporation and a symbol of Mexico’s national revolution, to private investment, a gambit that requires a constitutional amendment.
Since then-president Lázaro Cárdenas expropriated Mexico’s petroleum industry from Anglo and American owners and nationalized it in 1938, the United States has been trying to take it back. "Transnational pressure to reprivatize PEMEX has been brutal," observed John Saxe Fernandez, a professor of strategic resource studies at Mexico’s autonomous university, Universidad Nacional Autónoma de México.
During the run-up to the hotly contested 2006 presidential elections, candidates Calderón and López Obrador debated the privatization of Mexico’s national oil corporation before the American Chamber of Commerce in Mexico City; former US ambassador Jeffrey Davidow moderated the debate. When the leftist López Obrador insisted that he would never privatize what belonged to all Mexicans, the business leaders stared in stony silence. The conservative Calderón’s pledge to open PEMEX to private investment drew wild applause. Calderón was, of course, Washington’s horse in the fraud-marred election.
In order to accommodate Washington, Calderón needs a two-thirds majority in the congress and the PRI’s votes in the lower house are crucial to guaranteeing passage of a constitutional amendment. "Without the PRI’s votes, PEMEX will not be privatized. That is why Calderón has granted Ruiz impunity," Saxe Fernandez concluded.
Washington is eager to see PEMEX privatized, which would create an opportunity for Exxon Mobil Corp. and Halliburton (now PEMEX’s largest subcontractor) to walk off with a big chunk of the world’s eighth-largest oil company. Pushing Calderón too hard to do justice for Will could disaffect the PRI and put a kibosh on the deal.
It is not easy to imagine Brad Will as a pawn in anyone’s power game, but as the months tick by and his killing and killers sink into the morass of memory, that is exactly what he is becoming. 2

A kid gets killed in the cross fire of a shooting. Someone digs up a human skull while planting begonias. An elderly woman dies in her sleep in an apartment no one has visited in years.
In all these cases, somebody or somebodies has to examine the scene and, well, the bodies to find out what happened. And as any fan of hard-boiled detective stories, CSI, or Quincy, M.E. knows, those somebodies are the forensic team, perhaps most prominently the coroner.
It’s a mysterious job with macabre connotations, imbued with a mix of excitement and dread. A new show on Spike purports to show armchair detectives what it’s really like, with Grand Guignol bravado, but I always wonder, is that really how it is? So I decided to find out.
GOING DOWNTOWN
I start with our own fair city of night, only to discover that the subject of coroners is more complicated than I thought. What TV often portrays as one or two jobs is often many different jobs. And San Francisco County doesn’t have a coroner a position defined as an elected or appointed government official who deals with deaths that raise questions. Instead, it has a medical examiner, whose office is headed by an MD or doctor of osteopathy. The difference may seem like semantics, but it’s an important distinction for people in the field.
I also learn that it will be next to impossible to meet San Francisco’s medical examiner, Dr. Amy Hart. Unlike her predecessor, Dr. Boyd Stephens whose media accessibility and subsequent scrutiny led to controversies about the reuse of needles, improper ventilation against dangerous pathogens in autopsy rooms, misappropriation of funds, and sexual harassment Hart is fairly shy when it comes to the media. Public controversy can be a downside to the job, whether it’s over the contested findings of Los Angeles’ fabled "coroner to the stars" or the unpopular study by Marin County’s coroner of suicides on the Golden Gate Bridge.
So I get the basics about the job from Hart’s deputy administrative director, Stephen Gelman, at the ’50s-era Medical Examiner’s Office on the grounds of the Hall of Justice. Gelman, a middle-aged, white-haired former special agent with the Department of the Treasury, explains the makeup of the office: 32 people, including forensic pathologists and anthropologists, toxicologists, chemists, investigators, and administrative personnel.
And becoming part of Hart’s team isn’t easy, especially since forensic-themed TV shows and the office’s involvement with UC San Francisco managed to attract 160 applicants during a recent call for three positions. Preference is given to those with a background in medicine and, at the very least, the funeral industry.
"IT’S CHINATOWN …"
But those are just the facts. My experience at the Alameda County Coroner’s Bureau, an art deco, cream-colored building on the outskirts of Chinatown, is much more visceral.
Inside I meet the genial Lt. Jason Arone, who explains that the bureau has been under the jurisdiction of the Alameda County Sheriff’s Office since 1989. That gives Sheriff Gregory Ahern the title of chief coroner, but on a day-to-day basis, Arone is the guy in charge. I also meet Mike Yost, a former detective who is now a public administrator, which means he handles the belongings of decedents, from pets to hidden stashes of money.
Downstairs, the morgue is pretty much what movies would have you expect: cold metal and antiseptic green tile. Arone pauses at the sound of a saw we can’t go inside if there’s an autopsy under way. But it’s just carpenters fixing a door. Inside, I’m struck by the lack of sliding-drawer coolers bodies are identified by photograph these days and are kept in less-obvious storage rooms.
Then I meet autopsy technician Smiley Anderson sometimes referred to as "the bullet finder" by resident pathologists. The 25-year veteran started working in his family’s mortuary as young man in the South much the way many in coroner’s offices got their start. But Anderson says the field is changing now. Crossover careers are rarer, and he says the best way to get in is through an education in medicine.
As I sit at his desk outside the autopsy room, I notice what Arone calls "the meat-locker smell." It’s neither the smell of embalming fluid that I associate with funerals nor that of decay just a stale, permeating reminder of what’s inside.
OUT IN THE FIELD
It’s midafternoon when I meet Alameda County Coroner’s Bureau detective Eric Larson, who’s agreed to show me the other side of the job: going out on calls. I wait with the jocular thirtysomething until two calls come in.
One is a follow-up from the night before. A young girl and her brother were at the house of a family friend, which also serves as a rehabilitation facility; soon after dinner both fell ill. The brother recovered, but the young girl died. Larson decides to ask some questions, though the toxicology report is still pending.
The other call is a notification about a suicide on the Golden Gate Bridge. (Sometimes Alameda County representatives will handle calls for Marin County if the next of kin is in the East Bay.)
Larson puts on his flak jacket as part of his routine, and we get into one of the department’s cars. Since it’s not a pickup, he says, we won’t need one of the vans.
The first stop is at a sagging west Oakland house. The man who answers the door is barely coherent but sends us to Children’s Hospital. When we get there, I’m amazed to see the little boy we got the call about bouncing up and down, chewing on a french fry. When he sees Larson, he starts singing, "Bad boys, bad boys …" Larson laughs and says, "That’s my favorite song, buddy." The child’s hale liveliness is heartbreaking with the knowledge I have of his sister.
Larson asks the family friend, who’s at the hospital, for any information on the night before. It’s unclear whether he’ll get answers, and he tells me that sometimes he never does. In fact, that’s one of the hardest parts of the job. "It doesn’t matter how much science you throw at it," he says. "Sometimes it comes out undetermined."
It’s getting late as we head to the home of the suicide victim’s sister in Castro Valley. No one answers the door. Larson checks with the Marin County Coroner’s Office for another address, then stops by a dispatch office to get directions. Notification is important to Larson, as people may otherwise never hear about the fates of their loved ones.
We arrive in a quiet, ’70s-era housing tract in San Leandro, at the house of the victim’s mother. Again, no one is home, but a neighbor with emergency keys checks the house, determining that the victim’s mother has gone for a walk with her dogs. We wait at the house.
When she arrives, she knows what Larson’s going to say before he opens his mouth but the news is no less brutal. When we leave, her neighbors are sitting beside her on the couch, friends from happier, simpler times.
It’s late when we return to the office, and Larson is supposed to work another swing shift tomorrow. But he gets a message from home. The son of a friend died in an accident. The funeral is tomorrow.*

There’s lots of talk about a compromise that might avert this fall’s campaign battle between advocates of giving even more space to cars (the downtown, developer and conservative players who paid $60K for a measure to undo progressive city parking policies) and those who understand that we must fix Muni and provide for more transportation alternatives if we’re to avoid gridlock, global warming, air pollution, and ugly and dangerous auto-centric neighborhoods.
But personally, I think this is a debate that we should confront head on — particularly now that top campaign consultant Jim Stearns will be running the effort to approve Sup. Aaron Peskin’s Muni measure (which will kill the heinous pro-parking proposal if it passes, thanks to Peskin’s smarts and spine). “This is the future of San Francsico transit that we’re debating,” Stearns told me.
A hard-fought campaign would also expose Gavin Newsom’s underhanded tactics in undermining smart growth policies on behalf of his downtown backers, as well as a new analysis by Planning Director Dean Macris of how the downtown-backed parking push would reverse city policy and conflict with our General Plan in ways that may be illegal, and which are most certainly short-sighted and stupid.
But then again, this parking measure is so bad that perhaps we should opt for certain death instead of giving it any chance at all, as long as we don’t weaken the city’s long-established transit-first stance in the process.
EDITORIAL There is much to like and some things not to like in Sup. Aaron Peskin’s Muni reform measure, but the most important thing the measure does is demonstrate that Muni won’t get better unless the city also works on controlling car traffic in congested areas. It’s a critical policy issue that’s going to be the subject of a heated fall ballot campaign and so far Mayor Gavin Newsom is planted squarely on the wrong side.
Nobody can dispute the motivation behind Peskin’s charter amendment: Muni is a train wreck right now, with service far below acceptable levels. Something has to change, and the way he’s proposed it, the system would get an additional $26 million in guaranteed city money, and Muni management would have some expanded ability to set performance standards and require the staff to meet them.
We would, of course, prefer that the dedicated Muni money come from some new revenue stream, not from the existing General Fund. And we’ve always believed that the supervisors and the mayor should have to sign off specifically on any Muni fare hike. But overall, a lot of what Peskin is proposing makes sense and now that he has worked out the problems that labor initially had with the measure, it has a good chance of winning this fall.
The mayor thought so too and had endorsed the proposal until Peskin took the critical step of adding in restrictions on downtown parking. That would undermine the plans of big developers and their allies, who want the right to add a lot more parking spaces and curb openings for their luxury condo projects downtown.
The developers, with the help of Gap founder and power broker Don Fisher, are trying to get their own ballot measure passed, one that would greatly expand downtown parking. That’s exactly the wrong direction in which San Francisco should move.
In fact, what the city needs is a policy directive aimed at reducing the number of cars downtown and keeping the total number in the city from rising. Current planning documents and projections are all based on the assumption that more cars will pour into the city over the next 10 years, and that may become a self-fulfilling prophecy. But it doesn’t need to be.
San Francisco is one of the most environmentally aware cities in the world. And as more residential development comes in downtown, there’s absolutely no reason why this city can’t stick to its transit-first policy and set a goal of reducing congestion in the urban core.
Others cities are doing it. London has had tremendous success with restrictions on driving in its central City (and a stiff price tag for doing it). New York is looking seriously at congestion pricing, and San Francisco ought to be pursuing Sup. Jake McGoldrick’s idea of bringing the concept here.
And the cold, hard fact is that fewer parking spaces means fewer cars. If the value of downtown high-rise condos is that they will encourage people to walk or take transit to work, why fill the basements with parking garages?
If San Franciscans want Muni buses to be able to negotiate rapidly and efficiently through the downtown area, why shouldn’t the city do everything possible to clear some of the car traffic out of the way?
Newsom was willing to support the Muni measure and knew in advance, Peskin tells us, that parking limits were going to be part of it but the minute his downtown backers started to yelp, he backed away. Now the mayor is in the position of opposing Muni reform in the name of helping developers build more parking in a city that already has too many cars. That’s a terrible place to be for a mayor who tries to portray himself as an environmentalist. *
TECHSPLOITATION The future is a crowded graveyard, full of dead possibilities. Each headstone marks a timeline that never happened, and there’s something genuinely mournful about them. I get misty-eyed looking at century-old drawings of the zeppelin-crammed skyline over "tomorrow’s cities." It reminds me that the realities we think are just around the corner may die before they’re born.
A few weeks ago I was trolling YouTube and stumbled across a now-hilarious documentary from 1972, Future Shock, based on the 1970 futurist book of the same name by Alvin Toffler. The documentary focused on a few themes from the book and tarted them up by throwing in a lot of trippy effects and sticking in Orson Welles as a narrator.
As Welles intones ponderously about how fast the future is arriving, we learn that "someday soon" everybody will be linked via computers. Essentially, it was an extremely accurate prediction about Internet culture. Score one for old Toffler.
Things go tragically incorrect when the documentary turns to biology. Very soon, Welles assures his audience, people will have complete control over the genome and drugs will cure everything from anxiety to aging. Through the wonders of pharmaceuticals, we’ll become a race of immortal super-humans. It sounds almost exactly like the kinds of crap that futurists say now, 37 years later. Singularity peddlers like futurist Ray Kurzweil and genomics robber baron Craig Venter are always crowing about how we’re just about to seize control over our genomes and live forever. So far we haven’t. But every generation dreams about it, hoping they’ll be the first humans to cheat death.
Some dreams of the future, however, shouldn’t outlast the generation that first conceived them. Suburbia is one of those dreams. In the fat post-war years of the 1940s and ’50s, it seemed like a great idea to build low-density housing to blanket the harsh desert landscapes of the Southwest. But now the green lawns of Southern California have become an environmental nightmare of water-sucking parasitism. Just think of the atrocious carbon footprint left behind when you lay pavement, wires, and pipes over a vast area so that nuclear families can each have huge yards and swimming pools instead of living intelligently in high-density green skyscrapers surrounded by organic farms.
Oh wait I just gave away my own crazy futurist dreams, inspired by urban environmentalism. Today, many of us imagine that the future will be like the green city of Dongtan, an ecofriendly community being built outside Shanghai using recycled water, green building materials, and urban gardens that will allow no cars within its limits. The hope is that Dongtan will have a teeny tiny carbon footprint and be a model of urban life for the future. Of course, that’s what suburbia was supposed to be too a model of a good future life. No future is ever perfect.
Perhaps the saddest dead futures, though, are the ones whose end may mean the end of humanity. I suppose one could argue that the death of an environmentally conscious future is in that category. But what I’m talking about are past predictions that humans would colonize the moon and outer space. As the dream of a Mars colony withers and the idea of colonizing the moons of Saturn and Jupiter becomes more of a fantasy than ever before, I feel real despair.
Maybe my desperate hopes for space colonization are my version of Kurzweil’s prediction that one day we’ll take drugs that will make us immortal. Somehow, I think, if we could just have diverted the global war machine into a space-colony machine sometime back in the 1930s, then everything would be all right. Today the planet wouldn’t be suffering from overpopulation, plague, and starvation. We’d all be spread out across the solar system, tending our terraforming machines and growing weird crops in the sands of Mars.
Of course, we might just be polluting every planet we touch and bringing our stupid dreams of conquering the genome to a bunch of poor nonhuman creatures with no defenses. But I still miss that future of outer-space colonies. I can’t help but think it would be better than the future we’ve got. *

Ritz sounds a lot like rich, and you might well catch a glimpse of some rich people as you make your way toward the Dining Room at the Ritz-Carlton, where you have taken care to make a reservation. You might see them, financiers and captains of industry with entourages of family, debouching from black Lincoln Town Cars in front of the hotel, a colonnaded fortress of marble that sits like the Parthenon on an outlier of Nob Hill. The rich are different from you and me, Scott Fitzgerald said, but they get hungry too, and they know a good spot when they find one.
When I last visited the Dining Room, about a decade ago, Sylvain Portay had just become chef, and the mâitre d’ was Nick Peyton, pioneer of the cheese cart. Both are gone now, off to other ventures, but the cheese cart remains reinforced by a champagne cart and a digestif cart while the chef’s toque came to rest three years ago on the head of Ron Siegel. His penultimate gig was at Masa’s, and Masa’s is probably the restaurant in the city that most neatly compares with the Dining Room. At both places, Siegel seems to have eased a certain Gallic haute rigueur and added notes of Asian whimsy without descending into chaos. The Dining Room at the Ritz-Carlton has long been, and remains, among the most formal and correct restaurants you will find in this city also among the priciest. But it isn’t stuffy, and the money spent, on the food and the enveloping experience, is money well spent.
Who among us could dislike a restaurant that sends bottles of fine champagne trundling from table to table on a wheeled apparatus laden with shaved ice? You know the wine is well chilled because you can see the bottles sweating as, one by one, they are lifted from the cart and presented to you, and if a glass of Henriot rosé ends up costing $22, then you will be glad you enjoyed your glass and didn’t order a second.
You wouldn’t really have had time to enjoy the refill, anyway, since the three-course à la carte menu ($74) is punctuated not only by a bread service but also by a sequence of dazzling amuses bouches, beginning perhaps with a creamed-spinach risole (a half-moon-shaped pastry pouch), continuing with a strip of crisp-fried Japanese butterfish presented on pickled daikon, and culminating in a divine sea urchin panna cotta, served like a bit of leftover sour cream in a martini glass and finished with a splash of extra-virgin olive oil infused with Tahitian vanilla.
Compared to these bright little dabs of flavor, flaring and vanishing like the glow of fireflies in the summer night, the first courses are large enough to last for several bites. A wild-mushroom soup required some assembly, with the puree poured from a glass teapot over a pair of lobster ravioli waiting at the bottom of the bowl. An heirloom tomato salad, meanwhile, consisted of several fat disks of blood-red tomato of that 11th-hour, beginning-to-split ripeness you sometimes find in the final minutes of farmers markets. Goat cheese, a familiar accoutrement to such salads, was well marbled here and jumbled among the mixed baby greens like strips of pork fat.
Since it is king salmon season for the first time in several years, one took delivery of the fish with some sense of greeting a long-lost acquaintance. (The three-course option gives you choice of starter, main dish, and dessert, but there are also several set multicourse menus, one of them vegetarian.) The salmon turned out to be a wonderfully crisped, medium-rare square of filet, presented on a green and yellow blanket of béarnaise sauce and English-pea puree, with some wild-mushroom dice and baby leeks enhancing the sense of rich earthiness.
Sea bream en papillote, by contrast, struck an ethereal note. The fish, along with a bouquet of lemon verbena, was cooked to exquisite moistness in a glove of aluminum foil, which was presented whole before being cut open tableside. The dish also filled out our daily ration of pasta pillows; once the filet had been extracted from its crinkly lair, it was laid to rest on a handful of porcini ravioli, with lemon verbena sauce poured around.
The cheese course, at $18, isn’t a bad deal. You get four choices from the day’s array of cheeses, and the chunks (along with bread, grapes, mulberry jam, honeycomb, and roasted almonds) are big enough to share. We noted several varieties from Cowgirl Creamery on the cart; 10 years ago, almost all the selections were from France. I let the cheddarhead have at it while contenting myself with a glass of Darozze Armagnac ($16), poured from the lazing digestif cart. Armagnac has a pleasant fieriness, almost like a cross between cognac and calvados.
Dessert brought our only disappointment: a chocolate savarin that seemed dry despite a good soaking with some orange liqueur. The chocolate manjari caramel cake, on the other hand escorted by a tuile and a pat of walnut ice cream was alive with moistness and suppleness, and no wonder it’s a mainstay of the pastry menu. Then there were the petits fours, followed by a parfait, of blueberry-fennel crumble atop lemon verbena cream atop strawberry jam a school’s-out-for-the-summer treat subtly adjusted for an adult sensibility.
According to Open Table, the restaurant’s dress code is "jacket preferred," and that is probably enough to ward off hip-huggerists. At least we saw none. The tone, as in the rest of the hotel, is one of old money comfortable in its skin while gliding across a red and gold carpet of quiet beauty and richness.*
CHEAP EATS I don’t even know the name of this river. Three, four, maybe more years in a row we’ve been coming here, and the women bring magazines. My brother and Wayway and Jolly Boy go fishing and don’t catch fish. I sit on the rocks with a pen and don’t catch poetry.
At the bottom of the river, on a slimy rock, sits a barrel-shaped bug with four black legs sticking out of its head, an off-center orange dot, and I swear barnacles …
Nature is so punk! Here’s a duck with a Mohawk, and eight cute little ducklings, then the next day seven. Then six … The river speaks for itself, no fish, no poetry, all rocks and swirl, and yesterday a young woman from the campground wandered downriver to us, on something and full of questions. Where are you from? Are you white? Do you have kids with you? Who here don’t you like?
Dogs lick toads to hallucinate. Cats like catnip. Nature uses. Our "innocents" high on s’mores and we in our various states of adult intoxication decide, sitting around the fire, that the young upriver woman is a serial killer. This distracts us temporarily from the very real fear of bears, who have been knocking over our bear boxes, breaking into cars, and sniffing our tents in the middle of the night.
If the campfire is town square, or San Francisco, then I pitched my tent in Sonoma County, in a dense, dark cluster of pine trees. Why? I’m lonely enough. Do I still need distance? Seclusion? I’m not brave. I have nothing to hide, even less to prove.
But when I get up to pee the stars comfort the fuck out of me. And when I curl back into my warm, soft wrappings, I am surer than ever that I am dead. The adamant meat eater’s comeuppance: to play the juicy part of a bear’s burrito. I lie awake and breathless, listening to pine cones decompose, and seriously consider just sitting outside until morning. On a rock. With a pen.
The river speaks for itself, but Taqueria San Jose needs me. One tiny shrimp taco has 10 times as many shrimps on it as Papalote’s. But the salsa’s not great.
But no line. In fact, no one at all. A newspaper clipping on a post says San Jose’s are the best tacos in the world. I wouldn’t know, but I can tell you it’s my new favorite taquería.
My companions barely touched their food.
The Maze, just back from New York and St. Louis, couldn’t believe that his chicken was chicken. Anyway, it wasn’t the way he’d wanted it. And his friend from work didn’t seem too thrilled with her quesadilla. I tried to interest them in tasting my tiny taco, or side-order ceviche, but they weren’t biting. I think they were put off by the place’s unpopularity.
I don’t know why I love empty restaurants. Maybe it’s the same impulse that makes me pitch my tent where no one else is. And maybe it will be the death of me, by mauling, exposure, broken heart, food poisoning, serial-killing camper chick … One thing: I won’t die of starvation.
The Maze, who might, asks as many questions as our campfire killer. Although, admittedly, his make more sense. I’d wanted to hear about his adventures in New York and St. Lulu, but mostly we talked about the usual: ethics, spirituality, chickens. I’d missed the tangling tree roots of his forehead and tried to keep him perplexed with my goofball philosophies.
At the bar I mostly talked to her. We had the same favorite restaurant in New Hampshire! I didn’t know if they were on a date or what, but she left first, and he walked her out, then came back and walked me home. Not that he meant to; we just couldn’t stop talking. He had a million questions and it was a beautiful night. I don’t think he knew if he was on a date either.
Something had happened between them, and he seemed wracked with amazement and uncertainty. "How do you know …," he asked, rhetorically, and before he could finish the question I said, "You don’t."
My stomach growled. We were standing outside of Sockywonk’s, whispering, so as not to wake her neighborhood’s dogs and babies.
I already knew the answer (no), but anyway I invited the Maze inside. I wanted his burrito, and never have I meant a thing more literally. He had most of his rejected dinner with him, in a bag. If he didn’t want it, I did.
Does my longing speak for itself? Does it have a name, or fish in it, or poetry? It kills me how few people have ever even heard of Richard Brautigan. *
GREEN CITY It seems like most of the recent talk about global warming has been in terms of its apocalyptic potential in the distant future. Yet Bay Area heat waves and soaring temperatures in the Central Valley of late could certainly cause me to wonder whether it’s already begun. What has happened to our legendary cold summers and heavy rainy seasons? Sure, we’ve gotten patches of fog and wind, but for the most part this summer has felt, well, summery.
And apparently I’m not the only one thinking about climate change and what we need to be doing today to minimize it. Let me tell you, it’s going to take a lot more than driving a Prius and using energy-efficient lightbulbs to get the job done. That’s why the San Francisco Public Utilities Commission and the Department of the Environment published the city’s Climate Action Plan in 2004. The plan evolved from the Board of Supervisors’ 2002 resolution to reduce the city’s annual greenhouse gas emissions by 2012 to 20 percent below their 1990 levels and included a series of recommendations on how to achieve this goal.
In 1990, San Francisco emitted 9.1 million tons of carbon dioxide and other greenhouse gases, but by 2004 it was pumping out an extra 600,000 tons per year and counting. In order to get down to the ideal of 7.3 million tons by 2012, things need to make a major U-turn. Last month the San Francisco Civil Grand Jury released a report on how successful the Climate Action Plan has been so far, and while the city has made some progress in reducing its annual greenhouse gas emissions, the report noted that if the board’s goals are to be met, the entire city needs to step it up.
According to the grand jury report, the reduction of emissions in 2005 (the most recently available local emissions inventory) was "500,000 metric tons, only half the amount hoped," and "to achieve the reductions to 7.3 million tons by 2012 will require a tripling of the reduction rate."
The Department of the Environment remains optimistic. "We haven’t fallen behind," Mark Westlund, the department’s public outreach program manager, told the Guardian. "But we need to do more. We are currently at 1990 levels. At this point we’ve made the U-turn and are lined up to reach 7 percent [below] our 1990 levels, which would put us up to pace with the Kyoto Protocol’s goals, but we just need to ramp it up to reach our 20 percent."
City government can do a lot to control emissions. There are already regulations in place regarding the city’s vehicle fleets and setting green standards for municipal buildings. Mayor Gavin Newsom’s Green Building Task Force on July 11 announced a proposal to create incentives for private-sector buildings to adopt green building standards over the next five years.
Other city efforts include 2001’s Proposition B, which expanded solar power possibilities, and Community Choice Aggregation, which recently received preliminary approval from the Board of Supervisors; the latter program will allow the city to develop renewable energy projects on behalf of its citizens. But when it comes to making San Francisco a truly green city, much of the dirty work will fall to private citizens.
Nonmunicipal sources are responsible for 90 percent of San Francisco’s emissions, with a whopping 50 percent coming from private transportation, mostly cars. While the Climate Action Plan and the Civil Grand Jury report both give suggestions on how government agencies can motivate the public to reduce emissions, these suggestions can also be read as a map for how we can help ourselves. Simple changes in transportation habits more walking, bicycling, and public transit could cut 963,000 tons of greenhouse gases per year. And those who must use cars could carpool more often and switch to more-efficient vehicles.
The Climate Action Plan also indicates we can reduce emissions by an estimated 328,000 tons by changing how we live at home, including better energy efficiency and waste management.
Westlund told us, "Twenty percent is not just a municipal target, it’s citywide. Residences can help. Businesses can help. We’re all in this together. Getting the message out is half of it."*
EDITORS NOTES There was a fascinating moment July 11 at the San Francisco Board of Appeals meeting, a rare and revealing look into how city planning really works and who calls the shots.
At issue was a proposal for two condo towers at Tenth Street and Market, one of which would soar 352 feet into the air well above current height limits for the site. The developer also wants to put in 578 parking spaces, 399 more than the city Planning Code currently allows. It’s a monster of a project that would require seven planning code exceptions, two conditional use permits, and four zoning variances.
In other words, it’s not exactly what’s envisioned in the Planning Code for that particular lot.
But that didn’t bother Craig Nikitas, the city Planning Department staffer working on the project. In fact, in a long statement to the appeals board, Nikitas announced that city planners encourage developers to defy the current planning code since the planners think it’s outdated.
"The Planning Department encourages many project sponsors for tall buildings to use [a] height exemption," he said. That leads to "a taller building but a slimmer building…. That’s the kind of urban design we’re looking for nowadays."
Well, maybe but the Downtown Plan, passed in 1984, calls for a very different type of design. It seeks buildings with setbacks (the so-called wedding cake look). That approach, which we all fought over in hearing after hearing before the Planning Commission and the Board of Supervisors, was designed in part to maximize sunlight at street level. That look may be old-fashioned architecture; it may not be what the current generation of planners wants. But it’s official city policy, city law.
If Nikitas and his boss, Dean Macris, want to change the guidelines for new buildings, there’s a procedure for that. You recommend changes to the Planning Commission, which can hold hearings and send new Planning Code changes to the Board of Supervisors. Then we all can discuss them in our usual, moderately civil, San Francisco fashion.
But that’s not how it works. Behind closed doors, the planners decide what they want the city to look like. Then they encourage developers to fit that model and bend the codes to make it all fit.
This is nothing new, but it’s rare to get such a clear admission, on tape, of why city planning in this town is so utterly screwed up.
In other news: there’s a bill before the State Legislature that’s supported by the San Francisco Chamber of Commerce and the Guardian. Labor likes it. The mayor likes it. The supervisors like it. And it could bring the city another $71 million a year in badly needed revenue (more than enough, for example, to solve Muni’s structural budget woes).
And yet it’s hung up in a Senate committee because Don Perata, the East Bay senator who is the president pro tem, doesn’t want any tax bills to go to the floor this year.
The bill by Assemblymember Mark Leno would allow not require, but allow the supervisors to put before the voters a proposal to increase the license fees on cars in this city to the level they were before Gov. Arnold Schwarzenegger cut them statewide. If San Francisco voters choose to tax their own cars, they will have the option; that’s all it is. Yet Perata’s press aide, Alicia Trost, told me it won’t even get a vote.

More than 100 tractor trailers were lined up at 6:30 a.m., inching toward the Port of Oakland’s Terminal 7, waiting for their next load. Against the backdrop of the San Francisco skyline, a mammoth freight ship emblazoned with the name Hyundai glided toward the port, pregnant with multicolor shipping containers.
A driver told the Guardian that he expected to be in line for at least two hours waiting to drop off the empty container attached to his big rig. His 1989 truck lacks air-conditioning, so the windows were rolled down, allowing diesel exhaust to pollute the air he was breathing.
It’s the same scene at many of the port’s other terminals: long lines of ancient trucks slowly snaking toward their destinations, their primarily immigrant drivers performing the essential and thankless task of transporting cheap clothes from Asia to the nation’s big-box retailers or helping to export California’s agricultural goods to Hawaii.
The fourth-busiest container port in the nation, the Port of Oakland is the economic engine of the region, providing thousands of jobs and more than $1 billion in revenue. But activists say that the port system has also led to sweatshoplike conditions for truckers and created a health crisis for the surrounding community.
On their poverty-level wages, truckers are usually able to buy only the oldest, most polluting trucks. Their diesel pollution is a major factor driving asthma rates through the roof in the neighboring, primarily African American neighborhood of West Oakland, where, the American Lung Association says, one in every five kids has asthma.
A new national coalition of labor, environmental, and community activists has advanced a proposal that would make all drivers employees with benefits, radically changing the way work is done on the waterfront and possibly heralding the return of the Teamsters to the ports for the first time in more than 20 years. In the process, the proposal would make the port’s biggest customers responsible for its environmental problems.
The coalition places the blame for the current situation squarely on giant retail shippers such as Wal-Mart and Target and is calling for them to be held accountable for the full environmental and labor costs of the cheap goods they sell a call the corporations are strenuously resisting. The American Trucking Association, whose members contract directly with the corporation, has threatened a lawsuit if the change is adopted. But port officials have voiced a willingness to seriously consider implementing the proposal.
Having long claimed that the trucking industry is outside its control, the Port of Oakland could embrace the proposal as a means of satisfying community, environmental, political, and business concerns. With impending directives to clean the air coming from Sacramento, trade planned to almost double by 2020, two new Port Commission appointees representing labor and environmental concerns, and a federal antiterrorism tracking plan slated for this fall, the port is poised to play a leadership role that could reverberate up and down the West Coast and across the country.
THE TRUCKER’S LIFE
The Port of Oakland’s estimated 1,500 to 2,500 drivers are a far cry from the middle-class, long-haul Teamsters and the Smokey and the Bandit<\d>style freewheeling rebels who have long been engrained in the American imagination. Instead, they are at the bottom of the port’s food chain and are the most exploited trucking sector in the country, consisting primarily of recent immigrants struggling to make ends meet.
Dawit Fre, 39, immigrated to Oakland from the small nation of Eritrea two years ago. "I wanted to see a better life," he told us. Fre was a driver in Africa and went to work for the Port of Oakland after his cousin told him people start their trucking careers there. He said he works up to 60 hours a week for one company, making the equivalent of about $8 an hour after expenses.
Fre arrives at work every day no later than 6:30 a.m., waits for dispatches from his company, and spends a minimum of two hours in line for each container he picks up or drops off. He is paid $42 for each load by the company. He doesn’t know how much the trucking companies make but has heard that some get $200 per load. He returns home around 6:30 at night.
"The whole time I’m at the port, I’m thinking about my family," he said. "I got children. The only thing I’m thinking inside the terminal is, how many moves am I going to do? Am I going to do four or five or three or two?"
On a good day he can get four, on a bad day as few as one, depending on the length of the lines and the generosity of the dispatcher. Then there are his expenses. As an independent operator, Fre is solely responsible for a tankful of diesel that costs him up to $250 a pop. DMV registration is $178 a month, and 12 percent of his weekly earnings goes to his boss for insurance on his truck, not to mention annual federal income tax.
He receives no benefits, no overtime pay, and no health care coverage at a time when his wife, a diabetic, is suffering from severe stomach complications. "I’m taking her to Highland Hospital," he told us. "If it’s easy for them to fix, they can do it. But if she has a big problem, they can’t do it."
Fre has his own health problems. "Most of the drivers, we have old trucks," he said. "You don’t have AC, your windows are down, and you get sick in the truck" from the diesel. Fre’s remedy for his persistent coughing and the burning in his throat is several glasses of milk after each day of work.
A 1998 study published in the Journal of Independent Medicine found that truck drivers face a risk of cancer 10 times greater than Occupational Safety and Health Administrationacceptable levels, and a 1990 study published in the American Journal of Public Health showed that truckers face nearly double the average lifetime lung cancer risk.
Fre has little money to invest in his truck, a ragged 1987 model that he said needs $5,000 in repairs. He doesn’t trust it on the freeway, so he’s asked his dispatcher to send him only from pier to pier, not outside the port, further dipping into his earnings. "I came here to see a better life," he said. "When I got here, I found it is different. Here we don’t get paid for the overtime. We don’t get benefits. When I get into the terminal, there is no respect."
His experience is typical of those of port truckers across the country. A study by the East Bay Alliance for a Sustainable Economy, a labor-affiliated think tank, found that the average Port of Oakland trucker makes as little as $8 an hour after expenses, works 11 hours a day, and spends two and a half hours in line per load. Almost none of the truckers reported receiving benefits on the job, and 66 percent don’t have health insurance.
This is consistent with data from a 2004 survey of port truckers in Los Angeles and Long Beach, conducted by a professor of economics at California State University Long Beach. That report found they had a median income of $25,000 a year after expenses and an average workday of 11.2 hours, with up to 33 percent of their time spent waiting in line.
Port truckers generally drive only the oldest, most polluting trucks because that’s all they can afford. An industry adage is that ports are "the place trucks go to die," a reality that has dire impacts on the surrounding communities.
POLLUTING THE COMMUNITY
West Oakland has long been a dumping ground for the Bay Area’s toxic waste. The community has one of the five highest asthma hospitalization rates in California, with an estimated 20 percent of its K<\d>12 students suffering from the disorder, according to the ALA. Researchers at the University of Southern California have found that children living within a few hundred meters of freeways leading out of ports not only are more likely to suffer from asthma but also actually develop smaller lungs.
Margaret Gordon, a 60-year-old community health activist who has lived just blocks from the Port of Oakland for 15 years, told us that she and four of her grandchildren living with her all suffer from asthma. When one grandchild was born with severe asthma and her own asthma worsened after she moved to West Oakland, Gordon, then a housekeeper, started reading about the causes of asthma and made the connection to the port. Like many in the low-income neighborhood, she cannot afford to move elsewhere in the Bay Area.
Gordon has been fighting for clean air for more than a decade, and in April she was inducted into the Alameda County Women’s Hall of Fame for her work. In 2001, Gordon formed the West Oakland Environmental Indicators Project, which she now cochairs. The project has released more than half a dozen studies related to air quality. A 2003 report showed that trucks traveling through West Oakland in one day produce the same amount of toxic soot as 127,677 cars, leading to indoor air in some neighborhood homes that is five times more toxic than that in other parts of the city.
Still, Gordon told us that port officials are "only starting paying attention." Last year the California Air Resources Board passed a resolution related to air quality at ports and announced that it was developing a regulatory mechanism. A 2006 CARB report found that truck diesel exhaust accounts for the majority of the estimated 2,400 deaths related to freight transport each year and 70 percent of the state’s air pollution<\d>related cancer risk. Freight transport will cost California residents $200 billion in health costs over the next 15 years. Most of this is borne by low-income communities of color near freight transport hubs.
The combination of state mandates and local community concerns is starting to spark a change. "They would sit down and talk with us before that, but there was not anything concrete done," Gordon told us. The port is now in the early planning stages of an air-quality-improvement program, working with Gordon and other activists.
That movement is getting vigorous new support from the Coalition for Clean and Safe Ports, a national partnership of labor, environmental, and community activists organizing at the country’s major container ports: Los Angeles, Long Beach, Miami, Oakland, New YorkNew Jersey, and Seattle.
"Every one of those ports has the same environmental and labor problems we have in Oakland," Doug Bloch, the coordinator for the coalition in Oakland, told us during a tour of the port’s heavy industrial landscape. Virtually all of its 900 maritime acres are covered by concrete and asphalt, monster cranes that inspired Star Wars‘ Imperial Walkers, and 20-foot steel containers stacked up like Legos behind chain-link fences.
The Port of Oakland has no direct relationship with its truckers at the present. Shippers take price bids from among roughly 100 trucking companies at the port, then contract the work to the independent-contractor truckers. The CCSP says bidding wars lead to poverty wages for truckers, older trucks and more pollution, and a chaotic port full of inefficiencies like long pickup waits.
Under the proposed system, ports would call on their ability as landlords to set standards for the trucking and shipping companies. They would require trucking companies to hire drivers as employees, shifting maintenance costs from the drivers to the companies, which would retrofit or replace all port trucks with more environmentally friendly rigs. The ports would allow only new, cleaner trucks to enter. The companies could then, in theory, pass the costs on to shippers and end users.
If drivers were paid as employees by the hour instead of by the trip, the coalition expects the market would reduce inefficient truck wait times and air pollution.
"When you rent an apartment you sign a lease," Bloch told us. "If you trash the place, you get evicted. Corporations are trashing this community, but they’re not being evicted."
A test case could soon be under way at the ports of Los Angeles and Long Beach, the two largest in the United States, and the situation is being closely watched by ports and industries across the country. Port commissioners there had hoped by the end of this month to approve the coalition’s program, which they expect to reduce diesel truck emissions by as much as 80 percent over the next five years. But growing opposition and the threat of lawsuits by groups like the California Trucking Association, which represents the owners of truck companies, and the Waterfront Coalition, a consortium of major retailers, led the ports to delay their decision. The commissioners now expect to vote in September after completing an economic impact survey.
At the center of the storm is the fact that as employees, truckers would be able to organize and form a union. As independent contractors, they are barred from doing so because of antitrust laws originally created to oppose vast enterprises that dominated industries. (A further irony is that giant retail steamship companies have experienced incredible consolidation and enjoy a limited antitrust immunity.)
If passed by LA port officials, the plan would be implemented there starting Jan. 1, 2008, and could result in a domino effect at the other, smaller ports across the country. "The industry is fighting like hell in LA," Bloch told us. "They know that if they’re going to have to pay, the party’s over."
Meanwhile, Bloch told us that more than 1,000 truckers have signed a petition asking the Port of Oakland to pass a version of the coalition’s proposal, and it will be presented to the Port Commission, the seven-member body that would eventually vote on the proposal. Spokesperson Libby Schaff told us that the port "agrees with the coalition that the port can and should have a more direct relationship with its truckers" and is "very seriously considering the coalition’s proposal."
Because the proposal "constitutes a major overhaul of the way trucking is done today," Schaff said the port is currently holding stakeholder meetings with residents, truckers, terminal operators, elected officials, the business community, and labor to consider it in the context of a more comprehensive port plan. Schaff said a comprehensive plan could be crafted in less than a year.
The port has not taken a position on granting truckers employee status. It is also looking into other funding mechanisms for a clean-truck program, including money from a pending state bill that would impose a $30 fee on every 20-foot-equivalent unit passing through the Los Angeles, Long Beach, and Oakland port complexes, to be used for improvements in road and rail infrastructure and for clean-air programs.
The legislation, Senate Bill 974, by Alan Lowenthal (DLong Beach), would generate more than $525 million annually. But it faces tough opposition from some very powerful interests.
RESISTING CHANGE
Bill Aboudi, president of Oakland’s AB Trucking and a member of the CTA, told us truckers are "treated like second-class citizens," and he believes long lines and trucker asthma are serious problems. But he strongly opposes the coalition’s proposal. Instead, he told us, state regulations like those forthcoming from CARB and other piecemeal reforms are the answer.
"The coalition’s main goal is to unionize the drivers," Aboudi said. He was wearing a baseball cap emblazoned with two American flags and the words "Oakland Trucker." An immigrant from Israel, he has been at the Port of Oakland since 1992. "If these guys choose to be owner-operators, why are you rocking the boat? You can’t be playing with my livelihood just because you want to get union dues," Aboudi said. "Truckers want to own a piece of the American dream. They want to own their own truck."
It’s an appealing image to many. Kevin Leonard, an owner-operator trucker who contracts with Aboudi and others, told us he doesn’t want to give up his independent status. "I have the freedom to work when I want," he said. "I don’t see how the Teamsters can represent me better than I can."
The trucking industry as a whole says the coalition plan will force away trade and drive out small trucking companies, which will have to maintain the trucks and start paying benefits such as health insurance and workers’ compensation.
Yet Assemblymember Sandré Swanson (DOakland) brushed aside those arguments. "I’ve been involved in Bay Area politics for more than 30 years," he told us. "I’ve seen these same claims made against farmworkers as they were organizing for better conditions. I’ve seen these arguments made when we were raising the minimum wage. I think the opposite is true. If you have a workforce with a livable wage, it’s a more productive workforce, and I think everyone benefits. Truckers deserve more, and we’re going to do what we can to help them."
Oakland City Council president Ignacio de la Fuente, who drafted and helped pass a minimum-wage law for port employees, told us he supports the right of truckers to unionize but labor and environmental concerns must be balanced with economic growth. "You can’t ignore the fact that you have the port of Oakland competing with other ports," he said. "I support the fact that the Teamsters are going to bargain collectively on a national level. This port competes with other ports, and you cannot be put at a disadvantage."
Bloch says the coalition’s target is the shipping companies, not the trucking companies. "The shippers are hiding behind the trucking companies," he told us. "On the one side there are the giant shipping companies, like Wal-Mart and Target, huge global companies that demand low prices from trucking companies. On the other side are tiny trucking companies, immigrant truckers, and communities of color. Wal-Mart’s slogan is ‘always low prices,’ but ‘always low prices’ means one out of five children in West Oakland with asthma and drivers making $8 an hour who can’t support their families."
Oakland mayor Ron Dellums may be signaling his support for reform with two new appointees to the Port Commission. Even before he took office, Dellums was working to influence the Port Commission; as mayor-elect, he requested that outgoing mayor Jerry Brown hold off on appointing a new nominee so Dellums could appoint someone working on environmental and community impacts. He lost this battle when a majority of the city council voted to appoint Mark McClure, the director of marketing at a business technology company focused on security.
Dellums’s latest appointees, announced earlier this month, are a marked contrast to the business-oriented appointees of the Brown era: Victor Uno, a financial secretary with the International Brotherhood of Electrical Workers, and Gordon, the longtime resident and environmental activist in West Oakland.
"The port’s policy has been all about business and not about the people," Gordon told us. "The mayor really wants someone there to talk about health issues. I have never known a mayor to put someone on the commission and one of their engagements is to talk about health." She would also like to see a public participatory-process policy built into the port. "This is about sharing the power," Gordon said. "I don’t think West Oakland residents know they have power." She has "no problem" with truckers unionizing but also wants to find a way for drivers to remain independent contractors if they prefer.
Uno told the Guardian that he is highly supportive of the proposal. "I think that if the whole commission takes the lead of Mayor Dellums that this proposal will be very seriously considered," he said. "I’m very optimistic." Asked if he thought a proposal could succeed without requiring trucking companies to hire truckers as employees, he said, "I do not see how that is possible, given the lack of regulations in the trucking industry. It’s a dog-eat-dog world among independent truckers."
DEREGULATION HISTORY
The ports were not always structured as they are now. Before the 1980s the Interstate Commerce Commission regulated trucking, and most truckers at California ports were members of the Teamsters. They had health care, pensions, and workers’ compensation insurance and were paid a middle-class wage.
As part of a national push toward deregulation in the late 1970s, Congress, spurred by President Jimmy Carter, deregulated the trucking industry in 1980. In the following few years, a flood of new trucking companies entered the ports, with shippers choosing between a growing number of companies for each job. As small trucking companies undercut one another in bidding wars, the falling rates translated into declining driver pay, the bankruptcy of Teamster-organized companies, and increasing reliance on independent contractors whom companies could hire without spending money on payroll taxes, health care costs, or other benefits that unions might try to extract.
Trucking expert Michael Belzer, an economics professor at Wayne State University, has shown that long-haul truckers now earn less than half of prederegulation wages and work an average of more than 60 hours a week, while retailers like Wal-Mart have thrived. "The low rates paid to truckers in this global-trade game acts as a subsidy for increasing the amount of trade," Belzer told us. "Pollution and safety hazards are the negative externalities." If all ports on the West Coast required employee drivers, he said, "the market result would be that cost and safety would go up, and pollution would go down."
There have been a handful of Teamsters-related or trucker-led rallies and work stoppages at the Port of Oakland since deregulation, including a technically illegal strike in 2004 protesting the soaring price of diesel fuel, which virtually shut down the port for eight days. Many of the same complaints of today’s port truckers were aired at that time long waits in lines, poor pay, long hours, and no benefits.
"This business is like the Mafia," Lorenzo Fernandez, 36, said, standing in front of two metal taco trucks glinting in the noon sun, along with about a half dozen other truckers on their lunch break. "They’re doing whatever they want with us, between the [truck companies] and the shippers. There is so much competition between the companies, and they know that we need the job. They know that our kids will go hungry."
Muhammad Khan, 33, said he’s sometimes forced to make up for long wait times by driving dangerously fast on the freeways. "We have our families. We have to take care of them. We all risk our lives because we have to. We don’t make enough money if we don’t make a load," Khan told us.
"We’re all immigrants here," Fernandez said. "We make it possible for the economy to grow up, but they’re stepping on our faces…. We have to work together. Otherwise we are going to be slaves for life."
A sign on a chain-link fence near the taco trucks reads, "Got an old truck? The Port of Oakland can help! Replace your old truck today!" Call the number at the bottom of the sign, and a recorded message issues an invitation to an informational barbecue that took place four months ago. The message explains that the port will provide qualifying owners with up to $40,000 to replace trucks dating from 1993 or before with a 1999-model truck. But Schaff told us, "Due to overwhelming demand, new applicants are currently not being accepted."
Money for the program came from a $9 million settlement of a lawsuit West Oakland residents filed against the Port of Oakland in 1998, alleging that their health was being harmed by port operations. The port says it will replace a total of 80 of the estimated 2,500 port trucks with those funds. When asked if the port had a responsibility to truckers, Schaff said it was "consistent with the port’s commitment to social responsibility…. We’ve done a lot, and we’re going to do more."
But the only specific programs the port could point to were the truck replacement program, a trucker access committee and working group started after the 2004 strike, and new GPS cell phone technology that is being touted as a solution for bottlenecks. Chuck Mack, the Teamsters’ Western Region vice president, isn’t impressed. "They’re a joke," he said of the programs. "Very few independent contractors have utilized them."
The recent purchase of the GPS system particularly irritates Mack. "Here is a quasi-governmental agency supplying services to the trucking companies," he told us. "It’s bizarre that we’re using taxpayer money for this. Any other industry would buy the devices themselves."
"We don’t disagree with using this money" for truck replacement, Mack said, "but what you’re doing is blowing $2 million in taxpayer money. Years down the road they’re going to need a new truck and another million in taxpayer money. For Wal-Mart and Target it’s great because they can have the taxpayer pick up the bill. Without changing the model, it’s just a short-term fix at the expense of the taxpayer."
EMPLOYEE BENEFITS
Beyond the environmental and economic benefits of making truckers employees of the companies, the change also might improve port security. The federal Transportation Worker Identification Credential program, expected to be implemented in the fall, will check the identities of the nation’s 750,000 port employees, 110,000 of whom work as truckers. Under the present system, there is no way to track the independent port truckers.
Employees are easier to track, and they are also better for port security in other ways. Among low-paid port truckers, turnover rate is extremely high, according to the ATA. "We all know that having a stable, well-trained, reliable workforce only leads to more security," Bloch said. "If they’re trained, they can be the eyes and ears of the port."
Well-paid truckers also would lead to safer ports. In a 2005 report, Belzer showed that "a substantial fraction" of independent operators actually loses money each year, resulting in "a high risk of unsafe operations among those earning the least money." The low compensation also "presents a national security risk," his report read, "since those who desperately work to break even might be at risk to engage in activities that put the nation at risk, whether intentionally or unintentionally, just trying to find a way from not going under."
Driving past another long line of trucks idling outside a gate after lunch break, Bloch pointed out one truck. A placard on the back of the rig read, "End sweatshops on wheels."
The current port system "just heaps abuse and abuse on these truck drivers and this community," Bloch told us. "The big businesses like Wal-Mart don’t pay the cost of polluting Oakland. It’s the truck drivers and the community that pay the cost. People pay with their lives."
"You can’t fix the environmental problems without fixing the problems of the driver," he said. "And now you have labor and the community coming together, and that’s powerful."*
TECHSPLOITATION There is absolutely nothing wrong with enjoying truck commercials. Enjoying truck commercials can even be a politically innocent act it does not signify that you secretly lust after fossil fuels. Plus, there’s a payoff to admitting that such pleasures can be had guilt free: you can enjoy watching Michael Bay’s latest sci-fi actionfest, Transformers, on its own terms. If you’re one of the people who helped the flick earn more than $100 million during its opening week, you may not need my help. For those still fighting the urge to cheer for shiny trucks, I offer a few arguments to persuade you.
The first, most obvious case in favor of this movie is that it just looks neat. There are giant robots that turn into, among other things, SUVs, tanks, fighter planes, scorpion things, race cars, and yes, trucks with flames painted on the sides. It shouldn’t be too surprising that computer-generated imagery is the perfect tool for demonstrating how cars morph into robots. Haven’t you always wished that one day your boring old Prius would twist itself into a gigantic alien robot from the planet Cybertron?
Ah, Cybertron. This brings me to my next argument, which is that Transformers is one of those rare action movies about incredibly silly things that take those silly things dead seriously. No doubt you are as heartily sick of knee-jerk irony as the next chump who shelled out cash to see Ghostrider (OK, so I liked Ghostrider, but you know what I mean). There are no great actors in Transformers showing us how distanced they are from the trashy source material by "acting" à la Nicolas Cage. In Transformers, characters discussing the robots refer to them, with straight faces, as Optimus Prime and Megatron. The good guys are Autobots and the bad guys are Deceptacons. They are all trying to find a giant, unexplained box called the All Spark. Nobody raises an eyebrow at the total goofiness of this scenario. The film’s straightforwardness is downright refreshing.
Like other kid-friendly action films, Transformers is low on bloodshed and high on "Wow, that’s cool!" Even the film’s worst bad guy, a government secret agent played with snarky relish by John Turturro, never kills anybody. Instead of murderous mayhem, the movie offers us rampaging teenage hormones, packing the dialogue with cute but groanworthy double entendres about asses and dicks and humping. Not since E.T. has a movie aimed at tweens been this honest about how kids really talk: there’s a lot of creative cursing, and main character Sam (Shia LaBeouf) spends the entire flick trying to snog his hot pal Mikaela (Megan Fox). Thank you, Michael Bay, for removing rampant death from the action-movie genre and replacing it with dumb masturbation jokes.
What truly surprised me about the movie was that Bay did a fairly good job updating the concept for the 2000s. The film’s plot hinges on something Sam is selling on eBay, and there are a few good jokes about how the Autobots learned English on the Web (surprisingly, this does not mean that they yell "LOL" or "OMG" all the time). I was deeply amused when the evil Deceptacons hunt Sam down via his eBay listing, ambush him, then grab him in their giant metal fists so they can scream in his face, "Are you user LadiesMan217?"
Another way Bay updates the Transformers premise is by connecting the Deceptacons with the Middle East. The film has this sort of murky, inexplicable opening sequence that takes place in what we’re told is "Qatar, Middle East," where good US soldiers encounter mean, scorpion-shaped Deceptacons who smash the crap out of them. The Middle Eastern ‘bots look bizarrely like improvised explosive devices come to life; made of scrap metal and old tires, they hide in the sand and strike at unwary troops who are trying to be nice to the native folks. This is possibly the only part of Transformers in which Bay attempts to grasp feebly at political relevance and make something other than a zoomy truck commercial. Of course, he fails miserably. If you want to enjoy this flick without guilt, you will have to ignore the whole Middle East issue. Of course, one could say the same thing about living in the United States. Maybe Bay has succeeded in pulling off some social commentary after all: welcome to the United States ignore the Middle East stuff, but stay for the masturbation jokes and cool special effects. *
Annalee Newitz is a surly media nerd whose battle cry is "All hail Megatron!"
I don’t think anyone except Gavin Newsom’s inner circle and the folks who run Google and EarthLink really likes the mayor’s wi-fi contract, but it now appears at least possible that the Board of Supervisors will approve some version of it.
Board president Aaron Peskin wants the service improved a bit and is demanding some written guarantees that it will actually work the way it’s supposed to. Some opponents of the deal are arguing that it ought to be treated as a franchise, not a simple contract, and they want more legal hurdles. The serious techies say it’s the wrong technology anyway and will be outmoded and worthless in just a few years.
But there’s something bigger going on here.
A high-speed broadband system for San Francisco isn’t a hot dog stand and boat-rental shop in Golden Gate Park. It isn’t a restaurant lease on port property. It isn’t the naming rights for Candlestick Park or a permit to operate a taxicab or deliver cable TV.
Those are contracts and franchises. This is a piece of municipal infrastructure; it’s more like the roads that cars and Muni buses use to carry people around town or the pipes that bring water to our houses or the public schools that educate our kids or the emergency communications system that takes the call when we dial 911.
This is part of the city’s future, part of its economic development, part of how its citizens will participate in the political debate, part of how we will all learn and think and talk to each other. This is the new public square, the new commons.
Why in the world would we want to give it to a private company?
I don’t care if EarthLink and Google are offering 300 kilobauds per second of download time or 500 or 1,000. I don’t care if they promise to give free laptops to anyone who can stand on their head and shout "search engine." I don’t care if they promise to paint every light pole in the city green. They are private outfits set up to make a profit for investors. They have no business owning what will soon be the city’s primary communication system.
San Francisco has kept private operators from controlling its drinking water. This water is considered a basic part of life, and it’s available at low cost: San Franciscans pay less than one one-thousandth the price of bottled water for the stuff that comes out of the tap, and it’s almost certainly better. Same with roads and bridges, police and fire protection, and basic education (although that’s still a struggle).
I don’t get why broadband is any different.
I don’t think this would ever have been an issue 50 years ago. The generation that survived the Depression (with massive public-sector investment and ownership) and World War II (with huge excess-profits taxes on big corporations) and built things like the interstate highway system and the University of California didn’t see government as evil and inherently dysfunctional. The public paid to invest in public services.
It was Ronald Reagan and his ilk who took a generation disillusioned by Vietnam and Watergate and turned it against the public sector (see "Needed: A Campaign Against Privatization," page 5). Now we’ve even got a privatized war (and look how well that’s going).
The supervisors should get beyond the wi-fi deal’s little details and think about what it really means. This is San Francisco. We know better.<\!s>*
The Eastern Neighborhoods Plan has become a high-stakes battleground involving anxious developers stalled by a temporary building moratorium, progressives who want more affordable housing, concerns about dwindling light-industrial spaces and an exodus of African American residents, environmental justice, and a list of other issues that are central to this sprawling section of the city.
But the folks in the neighborhood known as Western SoMa are just happy that they’re no longer a part of that mess. Instead, they’re excitedly experimenting with a new approach to planning using an innovative and largely untested grassroots model.
Five years ago, when the city Planning Department first announced its intention to rezone the Eastern Neighborhoods, a group of disenchanted SoMa residents decided that they wanted to secede from that process and develop an independent, more comprehensive, community-based plan.
"A lot of us were offended by the Planning Department’s top-down, autocratic process," Jim Meko, who later became chair of the Western SoMa Citizens Planning Task Force, told the Guardian. "It was a bad process for everybody, but it was particularly bad for SoMa because the neighborhood had already been rezoned in the 1990s."
Meko survived three major demographic shifts within three decades: the AIDS epidemic that decimated SoMa’s gay community, the live-work loft zoning loopholes that gutted the artistic community, and the dot-com crash that displaced many techies. He feared that the Eastern Neighborhoods Plan would impose a "one-size-fits-all mode that treated all of SoMa like postindustrial wasteland."
So Meko set his sights on pressuring the Planning Commission to split his neighborhood from the rest of the Eastern Neighborhoods, which include the Mission District, Eastern SoMa, Showplace Square, Potrero Hill, and the Central Waterfront. Western SoMa is bordered by Mission and Bryant, 13th and Fourth streets, and Harrison and Townsend.
That dream became a reality in February 2004, and that November the Western SoMa Citizens Planning Task Force formed, with a stated objective to "recommend zoning changes that will preserve the heart and soul of their neighborhood, while planning for the realities of 21st-century growth."
Since beginning its work in 2005, the 22-member task force has met as often as five times a month and has created a values statement; a set of planning principles; committees focusing on business and land use, transportation, and arts and entertainment; and a committee that integrates a variety of issues.
Its June 28 town hall meeting was the first time the task force threw the doors open to the community at large, although the occasion happened to come on the heels of a high-profile budget battle between Mayor Gavin Newsom and Sup. Chris Daly, whose district includes SoMa and who helped set up the task force.
Within five minutes of Meko’s kicking off the meeting, a small but vocal group of attendees began to heckle him midspeech. Perhaps they were there to confront Daly, who had been slated to attend but was out of town. Whatever the reason, while accusing Meko of "having an agenda" and "using the bully pulpit" to present his own views, this faction was anxious to know how many task force members are property owners and which particular group of them would be dealing with crime, the fight against which Newsom has made a top budget priority.
For one wobbly, tension-filled moment, it felt as if this first crack at a citizen planning forum might crumble. But then another participant saved the day by requesting a simple but basic meeting ground rule: no personal attacks.
From that moment, the mood in the room lightened. Pretty soon the rest of the 150 residents who had gathered in the multipurpose room of Bessie Carmichael School on Seventh Street to share their thoughts on Western SoMa were talking about what they liked and what could improve. Even the hecklers quieted down and seemed to meld into the discussion.
As Planning Commissioner Christina Olague put it at the meeting, "This is possibly one of the most exciting things going on in planning. No one understands the heart and soul of a neighborhood like the people who live there. We hope this is a model other neighborhoods will adopt, because a neighborhood plan without the involvement of neighbors who live and breath a community is chaos just a bunch of buildings zoned in a language no one can read or feel."
But while residents were happy to create lists of neighborhood needs more parks, bike lanes, affordable housing, child care facilities, and trees; wider sidewalks; and fewer homeless people they were less keen on the idea of increasing building heights. One proposed means of financing improvements would be to increase allowable heights from 40 to 65 feet in some places.
Some locals complained about partygoers who urinate in the streets and play music loudly in cars instead of going home when the clubs close. But a youthful resident politely pointed out that "it may not be possible to stop young people from being young."
In the face of requests from senior citizens for more dinner theater and fewer nightclubs in SoMa, task force member and nightclub owner Terrance Allen observed that it’s probably only possible to "nudge existing conditions."
Recalling the battle that broke out between residents and partygoers after city planners decided to put affordable housing next to the wildly popular nightclub 1015 Folsom, Allen said, "You don’t want to start a war by putting subsidized housing next to the city’s biggest nightclub." Or as Meko put it, "We don’t want to set up conflicts by putting family housing across from the Stud."
By evening’s end, the consensus was that the meeting was a success. "We have much more in common than we have apart. That’s the whole key," said Marc Salomon, who sits on the task force’s transportation committee. As Meko told the Guardian the next day, "Wasn’t it a fantastic experience? It was the closest thing to a cocktail party without a bartender."
Meko said the task force is eager to complete its work and is shooting for having a draft plan ready by the next town hall meeting, on Oct. 24.
"But we need to do more community outreach," he added, noting that there weren’t many Filipinos at the first meeting even though they have a large presence in Western SoMa. "We’re looking at what SoMa could be like in 20 years. The other Eastern Neighborhoods are watching, and they are envious." *
GREEN CITY Pedaling or walking along a Panhandle pathway is the essence of green, a simple act of sustainable living and connection to a natural area within an urban core. It’s a calming, transformative activity at least until you get to Masonic Avenue and the telling words painted on the path: "Death Monsters Ahead."
The death monsters, a.k.a. automobiles, that bisect this three-quarter-mile-long green runway into Golden Gate Park would be jarring even if traffic engineers had made that intersection the best it could be. Instead, it’s closer to the opposite dangerous, illogical, and frustrating for all who must navigate it, a testament to what happens when the primary intersection-design criterion is moving cars rapidly.
After getting word of a rash of bicycle- and pedestrian-versus-car accidents at the Masonic-Fell intersection in recent months, Walk SF and the San Francisco Bicycle Coalition reinitiated (two years ago, it was the same story) a voluntary crossing-guard program on Saturdays and weekday evenings and lobbied City Hall to finally do something.
Sup. Ross Mirkarimi took up the cause, announcing at the June 26 Board of Supervisors meeting, "I find it simply unacceptable that the city has ignored the problem to the point where a volunteer program has become imperative. Traffic safety is a baseline city responsibility."
Mirkarimi is asking the San Francisco Municipal Transportation Agency, which has responded to years of complaints about this dangerous intersection with only minor and ineffective tinkering, to finally make a substantial change. He and the activists want a dedicated signal phase for pedestrians and bikes and a dedicated left-turn lane for cars coming off Fell.
It doesn’t take a traffic engineer to see what’s wrong with this intersection. Cars trying to turn left onto Fell from busy Masonic regularly get stranded by a red light and are stuck blocking the crosswalk. Even more dangerous is when bikers and walkers cross on their green light only to find cars which also have a green light turning left from Fell Street, cutting across their path.
The problem is vividly illustrated with too much regularity. I can still picture the female bicyclist who flipped through the air and crumpled to the ground a few feet from me after getting hit hard by a motorist. It was almost three years ago, but it remains a vivid, cautionary memory.
I was riding my bicycle west on the Panhandle trail, even with the motorist. Our eyes locked, his anxious and darting, and I knew he might try to cut me off, so I slowed. Sure enough, the driver made a quick left in front of me and hit the bicyclist coming from the opposite direction, who assumed that the green light and legal right-of-way meant she could continue to pedal from one section of parkland to the next. Instead, she joined a long list of Fell-Masonic casualties, to which attorney Peter Borkon was added May 19, a few days shy of his 36th birthday.
Borkon was on his road bike, training for the AIDS Life Cycle ride, when he cautiously approached the intersection, slowed, and unclipped from his pedals. When the light turned green, he clipped in, crossed into the intersection, and then, he says, "I was run over by a Chevy Suburban."
He was hit so hard that he broke his nose and gashed his face on the car, an injury that resulted in 15 stitches, and was thrown 10 feet. The fact that he was wearing a helmet might have saved his life, but he nevertheless went into shock, spent a day in the hospital, and is still waiting for the neurological damage to his face to heal.
How dangerous in that intersection? When I asked the MTA for accident statistics, a response to the criticisms, and a plan of action, public information officers Maggie Lynch and Kristen Holland first stonewalled me for two days and then said it would take two weeks to provide an answer.
Maybe Mirkarimi will spark a change, or maybe the MTA will just keep doing what it’s always done: plod along at a bureaucratic pace with tools ill suited to an evolving world that must do more to facilitate walking and bicycling as safe, attractive transportation options, even if that means delaying the death monsters.*

So the developers and some businesses want to build more parking in San Francisco. We’ve seen this game before; in the past, the supervisors have been able to shoot it down, but now it may go before the voters. Here’s the part of the argument that infuriates me:

Why is there an “expected influx of vehicles?”
Why is the city constantly looking for ways to plan for more cars?
Why isn’t it official city planning policy that the number of cars in San Francisco will decrease over the next five years?
This is the great lie of urban planning (as practiced by developers and their advocates): First you “project” more cars (or more jobs, or more population or whatever). Then you automatically have a case to build — more garages, more parking lots, more condos, more highrise office towers — for your “projected” demand. And, of course, once you bild million-dollar condos, they fill up (perhaps with globe-trotting wealthy people looking for pieds-a-terre, but whatever), thus fulfilling the “projections,” and once you make room for more cars, you’ll get more cars in a city that already has too many.
These “projections” are a bogus, self-fulfilling prophecy. Let’s project a city we really want, and plan for that one.
EDITORIAL Annual budgets can seem wonky and impenetrable, but they’re perhaps the most important statements of a city’s values and priorities. That’s why it’s critically important for the Board of Supervisors to make significant changes to Mayor Gavin Newsom’s proposed $6 billion spending plan, which is out of step with what San Francisco should be about.
Ideally, this month’s budget hearings would be informed by an honest and open discussion of what Newsom proposed in his June 1 budget, how it affects residents and Newsom’s political interests, and where the board might want to make some changes.
Unfortunately, both the San Francisco Chronicle and the Examiner have failed to offer a substantial analysis of the budget; instead, they’ve focused on sensational headlines about whether the mayor has used cocaine, personality conflicts between Newsom and Sup. Chris Daly (including a pair of over-the-top hit pieces on Daly in the June 23 Chron), and misleading spin coming from Newsom’s office and reelection campaign.
But there’s plenty of good budget analysis out there, thanks to the work of city agencies such as the Controller’s Office and the Board of Supervisors’ Budget Analyst Office, nonprofits like the People’s Budget Coalition, smart citizens like Marc Salomon, and reporting by the Guardian‘s Sarah Phelan ("The Budget’s Opening Battle," 6/20/07) and Chris Albon ("Newsom Cuts Poverty Programs," 6/20/07).
What that analysis shows is that the mayor’s much-ballyhooed "back-to-basics" budget which prioritizes public safety, cityscape improvements, home ownership programs, and pet projects such as Project Homeless Connect would make unconscionable cuts to essential social services and affordable housing programs, rely way too much on gimmicks and private capital to address public needs, and offer almost nothing that is innovative or befitting a progressive city at a crucial point in history.
Some specific examples and recommendations:
• Newsom’s 4 percent cut in the Department of Public Health budget which his appointed Health Commission took the unusual step of refusing to implement because the fat has already been trimmed away in previous budgets is unacceptable. It would slash substance abuse treatment, homeless and HIV/AIDs services, and other programs that would simply be unavailable if the city didn’t fund them. The board should fully restore that funding and even consider providing seed money for innovative new programs that would help lift people out of poverty. Only after the city fully meets the needs of its most vulnerable citizens should it consider cosmetic fixes like expanded street cleaning.
• The budget should strike a balance on cityscape improvements that is lacking now. Contrary to the alternative budget proposed by Daly, which would have cut the $6.6 million that Newsom proposed for street improvements, we agree with the SF Bicycle Coalition that many streets are dangerous and in need of repair. It’s a public health and safety issue when cars and bikes need to swerve around potholes. But the $2.9 million in sidewalk improvements could probably be scaled back to just deal with accessibility issues rather than cosmetic concerns. And we don’t agree with Newsom’s plan to add 100 blocks and $2.1 million to the Corridors street-cleaning program, which already wastes far too much money, water, chemicals, and other resources.
• As we mentioned last week ("More Cops Aren’t Enough," 6/20/07), the police budget doesn’t need the extra $33 million that Newsom is proposing, at least not until he’s willing to facilitate a public discussion about the San Francisco Police Department’s mission and lack of accountability. Sup. Ross Mirkarimi (a progressive who is strong on public safety and even clashed with Daly over the issue) was right to recently challenge the terrible contract that Newsom negotiated with the cops, which gives them a 25 percent pay increase and asks almost nothing in return.
• Newsom’s housing budget would move about $50 million from renter and affordable-housing programs into initiatives promoting home ownership, which is just not a realistic option for most residents and represents a shift in city priorities that serves developers more than citizens. Some of that change is specific to a couple of big owner-occupied yet fairly affordable projects in the pipeline for next year, but the budget also does little to address the fact that we are steadily losing ground in meeting the goal in the General Plan’s Housing Element of making 62 percent of new housing affordable to most residents, when we should be expanding these programs by at least the $28 million that the board approved but Newsom rejected. Similarly, the board should keep pushing the Housing Authority to apply for federal Hope VI funds to make needed improvements to the public housing projects rather than supporting Newsom’s Hope SF, which purports to magically turn a $5 million expenditure into $700 million in housing as long as we accept the devil’s bargain of 700 to 900 market-rate condos along with the public housing units.
• Finally, there are lots of little items in Newsom’s budget that could be cut to find funding for more important city priorities. Don’t give him $1.1 million to hassle the homeless in Golden Gate Park or $700,000 for his New Yorkstyle community court in the Tenderloin.
The bottom line is that a progressive city should not be pandering to the cops, punishing the poor, and polishing up its streets when so many of its citizens are struggling just to find shelter and make it to the next month. Newsom has forgotten about the ideals that the Democratic Party once embraced, but it’s not too late for the Board of Supervisors to correct that mistake. *
EDITORIAL There was a telling trio of events June 13 that illustrated what’s wrong with the current debate over public safety issues in San Francisco and why real police reform is needed before we spend $33 million to bolster the ranks of the San Francisco Police Department, as Mayor Gavin Newsom is proposing.
Newsom and his supporters gathered on the steps of City Hall to blast a proposal by Sup. Chris Daly to remove from the budget an extra class of police cadets (which the SFPD will have a hard time even filling, given its recruiting problems) and make other changes, denouncing the supervisor for supposedly endangering city residents.
It was shrewd yet shortsighted politics for Newsom to grandstand on public safety. But it was also demagoguery. Newsom is playing to people’s fears, pandering to the Police Officers Association, and hoping that people won’t notice how little he’s done to actually make San Franciscans safer, something that simply dumping more cops into a dysfunctional system won’t help.
The murder rate has soared under Newsom, who never followed through on his promise to "change the culture at the SFPD," content to let this deeply troubled agency manage itself. Newsom opposed the requirement of police foot patrols, helped kill violence-prevention programs, watered down an early-intervention system for abusive officers, and sabotaged an innovative community policing plan. Instead, he simply throws money at the department, tells us how deeply he cares, and calls that a commitment to public safety.
On the evening of June 13, San Francisco once again experienced the price of this lack of leadership when four young men were shot in the Friendship Village public housing complex in the Western Addition, which the SFPD had promised to regularly patrol. To bring the tragic point home, there was another shooting at the same spot the next morning.
"Today I’m all over the mayor and all over the police chief and all over city agencies to give me a detailed plan," Sup. Ross Mirkarimi told Bay City News. As well he should be. For all its resources, the SFPD has yet to work with the community on a comprehensive plan for keeping it safe.
The SFPD’s wasteful overkill by cadres of do-nothing officers gets displayed for all time and again: at peace marches, street fairs (particularly last year’s Halloween in the Castro, where hordes of cops standing around doing nothing failed to catch the guy who shot nine people), and now Critical Mass, where the 40 cops who accompany it seem to have no plan for managing the event and refuse to even take reports when cars hit bikes.
How are more cops going to help this problem? What we need is real reform, but unfortunately, Newsom and his allies keep trying to give this department more authority and resources without asking for anything in exchange.
Case in point: a charter amendment by Sup. Sean Elsbernd that was heard June 13 at the Police Commission meeting. In the name of reducing the commission’s disciplinary backlog and improving officer morale, Elsbernd proposed gutting civilian police oversight by handing the police chief much of the power now held by the commission and the Office of Citizen Complaints. The proposal was blasted by the OCC and the American Civil Liberties Union as a giant step backward.
Elsbernd tells us he’s working with those groups to maintain civilian oversight while accomplishing his goal of allowing the commission to focus on big policy issues rather than individual disciplinary actions. We’re not sure that’s possible without the establishment of a new body or substantially more resources going to the underfunded OCC.
But we do share his goal of creating an open, public dialogue about the SFPD within an agency that has the authority to implement reforms. Newsom has been unwilling to facilitate a frank public discussion of the SFPD’s practices, where they can be improved, and how much money the department really needs to do the job we want it to do.
Maybe the Police Commission, under progressive new chair Theresa Sparks, is just the place to talk about real police reform. *
Mayor Gavin Newsom and Sup. Chris Daly have been engaged in a high-profile clash over city budget priorities in recent weeks. Newsom appeared to win the latest battle when he galvanized an unlikely coalition and Daly clashed with some of his progressive allies, prompting Board of Supervisors president Aaron Peskin to remove Daly on June 15 as chair of the Budget and Finance Committee.
"This is not about personality, and it shouldn’t be about the mayor’s race. It should be about making sure we have a good budget," Peskin told the Guardian shortly before announcing that he would be taking over as Budget and Finance chair just as the committee was beginning work on approving a budget by July 1.
Yet this latest budget battle was more about personalities and tactical errors than it was about the larger war over the city’s values and spending, areas in which it’s far too early for the Newsom camp to declare victory. The reality is that Newsom’s "back-to-basics budget" which would increase spending for police and cityscape improvements and cut health services and affordable-housing programs is still likely to be significantly altered by the progressives-dominated Board of Supervisors.
In fact, while the recent showdown between Newsom and Daly may have been diffused by Daly’s removal as Budget and Finance chair, it’s conceivable that a clash between Newsom and the supervisors is still on the horizon. After all, eight supervisors voted for a $28 million affordable-housing supplemental that Newsom refused to sign, and the mayor could yet be forced to decide whether to sign a budget that lies somewhere between his vision and Daly’s.
Stepping back from recent events and the supercharged rhetoric behind them, a Guardian analysis of the coming budget fight shows that there are difficult and highly political choices to be made that could have profound effects on what kind of city San Francisco becomes.
If Daly wanted to spark a productive dialogue on whether the mayor’s budget priorities are in the best interests of the city, he probably didn’t go about it in the right way. But the approach seemed to be born of frustration that the mayor was refusing to implement a duly approved program for an important public need.
Daly has argued that when he introduced his $28 million affordable-housing supplemental in March, he thought it would be "noncontroversial." Last year the board approved and Newsom signed a $54 million supplemental budget, including $20 million in affordable-housing funds. Daly wrote on his blog that he hoped his latest $28 million request would help "stem the tide of families leaving San Francisco, decrease the number of people forced to live on the streets, and help elders live out their days with some dignity."
But Newsom objected, first criticizing Daly in the media for submitting it too late, then refusing to spend money that had been approved by a veto-proof majority, with only his supervisorial allies Sean Elsbernd, Michela Alioto-Pier, and Ed Jew opposed. Daly pushed back against what he loudly labeled the mayor’s "backdoor veto," which he considered illegal.
"You may not believe the question of affordable housing and affordability is more important than redesigning the city’s Web site or perhaps installing cameras in police cars or fixing a pothole, but to say that the money does not exist is a lie," Daly said at a board meeting.
So when Newsom submitted his final budget June 1, Daly proposed restoring the funding and taking away $37 million from what he called the mayor’s "pet projects." His suggestion triggered a political firestorm, since his targets included a wide array of programs, including $700,000 for a Community Justice Center, $3 million for one police academy class, $10.6 million for street repairs and street trees, $2.1 million to expand the Corridors street cleaning program, and $500,000 for a small-business-assistance center. In their place, Daly argued, the city would be able to restore funds cut from affordable housing, inpatient psychiatric beds, and services for people with AIDS.
In addition to uniting against him those constituencies whose funding he targeted, Daly’s proposed cuts in law enforcement and his brash, unilateral approach to the issue threatened to cost him the support of Sup. Ross Mirkarimi, a progressive with public safety credentials who represents the crime-plagued Western Addition. So it was a precarious situation that became a full-blown meltdown once the Newsom reelection campaign started phone banks and e-mail blasts accusing Daly of endangering public safety and subverting the normal budget process.
Pretty soon, with Daly’s enemies smelling blood in the water, it became a sort of feeding frenzy, and various groups urged their members to mobilize for a noon rally before the June 13 Budget and Finance Committee meeting. "We are a sleeping giant that has awakened," small-business advocate Scott Hauge claimed as he e-mailed other concerned stakeholders, who happened to include Friends of the Urban Forest and public housing activists, thanks to Daly’s call for a $5 million cut in Newsom’s Hope SF plan, which would rebuild public housing projects by allowing developers to also build market-rate condos at the sites.
"Mirkarimi seems to feel strongly about having cops and infrastructure, which are typically the priorities of conservatives," Daly told the Guardian as he announced plans to cancel the June 13 budget hearing, which he did after accusing Newsom of engaging in illegal electioneering.
Daly also accused Newsom of abusing his power by securing the City Hall steps for a budget rally at the same time, date, and place that Daly believed his team had secured a mess-up city administrator Rohan Lane explained to us as "an unfortunate procedural thing."
But while Daly told us he "needed to hear from progressives who enjoy diversity, because if we don’t get more affordable housing dollars, San Francisco is going to become increasingly white, wealthy, and more conservative," all anyone could hear the next day was a pro-Newsom crowd chanting, "No, Supervisor Daly, no!" outside City Hall.
Newsom spoke at the rally and claimed that Daly’s proposal to cut $5 million from Hope SF would eliminate "$95 million in local money to help rebuild San Francisco’s most distressed public housing," a figure that includes the bond issue Newsom is proposing. With the 700 to 900 market-rate units included in the program, Newsom claims the cuts will cost the city $700 million in housing.
"Stop the balkanization of San Francisco!" Rev. Al Townsend roared, while Housing Authority Commissioner Millard Larkin said, "People are living in housing not fit for animals. Protect policies that give people a decent place to live."
"This is about your priorities," Newsom said as he made the case that fixing potholes, sweeping streets, and putting more cops on the beat are now San Francisco’s top concerns.
"I’ve never seen this type of disrespect to the public process," Newsom said, addressing a crowd that included a couple of Daly supporters holding "Homelessness is not a crime" signs alongside people dressed as trees, a dozen people in orange "Newsom ’07" shirts, Newsom campaign operative Peter Ragone, and former Newsom-backed supervisor candidates Doug Chan and Rob Black (the latter of whom who lost to Daly and now works for the San Francisco Chamber of Commerce).
"Gavin Newsom’s budget reflects that he has been listening to you. It’s not something he has dreamed up is his ivory tower," Townsend said, while Kelly Quirke, executive director of Friends of the Urban Forest, pointed out that Daly’s proposal would mean the 1,500 trees that the Department of Public Works planted this year "would not be watered," and Police Commissioner Yvonne Lee said the proposal would "eliminate 50 new officers that could be on streets, plus a $400,000 system to identify the source of gunfire."
What Newsom’s supporters didn’t mention was that his proposed budget, which would add $33 million for the Police Department to help get more officers on the streets and pay existing officers more, also would drastically shift the city’s housing policies by transferring about $50 million from existing affordable-housing and rental-support programs into spending on home ownership and development of market-rate units. And that comes as the city is losing ground on meeting a goal in the General Plan’s Housing Element of making more than 60 percent of new housing affordable for low-income residents.
Daly doesn’t think people fully understand the implications of Hope SF and said public hearings are needed so they "can understand it better." Yet the Newsom rally still touted the mayor’s concern for those in public housing projects.
"We’re not interested in rebuilding unless the tenants are supportive," Doug Shoemaker of the Mayor’s Office of Housing told the Guardian, promising that existing public housing units will be replaced "on a one-to-one basis" and noting that 85 affordable rentals, along with 40 to 50 units for first-time home buyers at a below-market rate (for a household of two with an income of about $58,000 annually) and hundreds of market-rate condos, will be built.
"The market-rate condos will cross-subsidize the rebuilding of public housing," said Shoemaker, who claims that the "lumpiness of the mayor’s budget" in which home-ownership funding increases by $51 million, while programs benefiting the homeless and senior and families renters appear to have been cut by $48 million "is best understood over the long term" and is related to the redevelopment projects in BayviewHunters Point and Mission Bay.
"The hardest thing about explaining these figures is that it sounds like a game of three-card rummy, but we need to fuel whatever is coming down the pipeline," he said.
The confusing fight over affordable housing has even split its advocates. Coleman Advocates for Children and Their Families publicly urged Daly not to hold Hope SF funds hostage to his housing supplemental, while the Family Budget Coalition urged Newsom and the supervisors to "work together to find at least $60 million during the add-back process to prioritize affordable housing."
But with Daly gone from the Budget and Finance Committee, how will his proposals and priorities fare? Sources say Peskin was irritated with Daly’s budget fight and his recent Progressive Convention both actions not made in consultation with colleagues as well as his increasingly public spat with Mirkarimi. Yet Peskin publicly has nothing but praise for Daly and supports many of his priorities.
"We are working with the same schedule that Daly’s office laid out," Peskin said, noting that a lot of the decisions about funding will depend on "what ends up coming from the state." San Francisco could still lose money from the state or federal budget. During a June 18 budget hearing, Sup. Bevan Dufty introduced a motion to amend the mayor’s interim budget by appropriating $4 million for HIV/AIDS services, to be funded by General Fund reserves, for use by the Department of Public Health.
This was one of Daly’s top priorities, and as the hearing proceeded, it became clear that there was a method in the former chair’s apparent budget-dance madness. Newsom’s budget would restore $3.8 million of the $9 million in AIDS grants lost from federal sources, with Newsom asking Congress to backfill the remaining reductions to the Ryan White Care grant. Sup. Sean Elsbernd questioned the wisdom of appropriating $4 million now, when the feds may yet cough up, and Mirkarimi questioned whether doing so would send Washington the message that it doesn’t need to help us.
"It’s a discussion we have every year," Controller Ed Harrington said. He recommended appropriating $4 million now and sending the following message: "Yes, we think this is important, we’ll try and figure out how to fix it, but this shows it isn’t easy. It’s a political call rather than a technical one."
In the end, the Budget and Finance Committee voted 31, with Sup. Tom Ammiano (the only supervisor to publicly support Daly’s alternative budget) absent and Elsbernd dissenting, to appropriate $4 million, on the condition that if additional federal and state funds are granted to backfill the Ryan White Care grant, the controller will transfer the $4 million augmentation back to the General Fund.
The same kind of balancing act is expected on Daly’s other suggestions to restore funding for affordable housing and public health departments, so it’s still too early to tell whether his priorities might ultimately win the war after losing the battle.*

It may sound cliché, but there’s no other way to put it: my nightlife sucks. With two shitty day jobs and a barely blossoming career as a freelance journalist, it’s nearly impossible for me to find enough time or money to enjoy this city after dark. It hasn’t always been this way: I used to spend my evenings gleefully cross-eyed, rubbing knees with random hedonists, pushers, and hell-raisers. I used to go skateboarding in night goggles and camp nude in the Tenderloin. Goddamn it, I used to have it all!
I’ve thus far managed to maintain sanity by telling myself that hard work produces success, but my self-imposed exile to the sunlit hours is rapidly taking its toll. Gray hair, bedroom alcoholism, and soul-crushing anxiety shouldn’t affect me for another 10 years or so. Yet here I barely stand at the ripe age of 28, a boring fucking wreck. In order to salvage some of my formerly wild personality and rather than shoot myself or seek expensive therapy I decided recently to take the plunge into the comprehensive virtual world of Second Life. Might as well throw down with some wart-nosed trolls and weirdo Wizards of Nardo, right? Pass the magick toad grog, Tinker Bell. Yep, I’m just that desperate.
A LITTLE HELP HERE?
With all the hype surrounding Second Life and its maker, Linden Labs, you’d think the game would be a fairly simple thing to pick up. Not so, my friend. The first obstacle I ran into was of the technical variety. After installing SL and choosing a sly code name (Justyn Jewell, natch), I thought I was good to go, but my poor old Dell crashed whenever I tried to wiggle my virtual buttocks. My friend Tony, a notorious group gamer at Stanford, hates it when I call him with computer questions but was surprisingly enthused about the opportunity to share his SL wisdom. He even agreed to come over that very night and lend me his vacationing roommate’s brand-new MacBook Pro until she got back. Score.
First lesson: customizing an avatar. Perversely, I chose the Boy Next Door body template and then altered its features to match my own. After some meticulous tweaking, Justyn Jewell was no longer your average joe. He was a tragically good-looking skinny white dude with slick brown hair and sleek black shoes. I also gave him a handlebar mustache, because I’m up-to-the-minute like that.
Tony spent the next few hours teaching me the basics. When he left that night, I was able to walk, fly, teleport, take a piss, and hold brief conversations. I was still having trouble picking things up, touching people, and not walking into corners, but it was too early to worry about socially acceptable advanced maneuvers. For a man who hadn’t touched a video game since Mario Bros. III, simply stumbling through SL’s intricate landscape felt like enough. Getting beyond that was going to be a bumpy road, but Tony promised to come back and teach me some more when the time was right.
AVATAR, AWAY!
My first few weeks with Second Life were just what I needed. Whenever my brain grew weary from writing another puff piece about the latest hair-removal technique ("Experience the smooth, toning pleasures of La Cage Aux Follicles"), I would log on and select one of the thousands of clubs from the Popular Place menu. Immediately, I’d shoot to an island dedicated to house, techno, hard rock, hip-hop, or what have you. Each venue was full of kitted-out avatars who acted as though they were at a real party. "Woo-hoo!" they would say. And "This party is sooo amazing!" I knew it was all fake, but I was getting a visceral thrill watching my doppelgänger mingle with squirrel people, virtual heshers, cocky shot-callers, and impossibly elfin ravers.
The possibilities kept me endlessly occupied. I started out mainly going to standard Ibiza-like situations but soon wound up frequenting a hip-hop club called Insatiable, where people ground to slightly less-than-cutting-edge tunes by Ludacris and Fat Joe. I tried to spice things up by talking to people wherever I went, but my standard greeting, "Whacha gonna do with all that ass, all that ass inside them virtual jeans?," was often met with a cold shoulder or yawn even at Club Insatiable! The reason was obvious. While nearly everyone else had wild hairdos, tattoos, designer outfits, and sparkling electro-bling, I was still in stock attire, a boring newbie who didn’t know shit. It was time to get some gear.
Perusing boutiques in SL made me realize just how Vegas-like this virtual world can be. Everything is for sale. Shirts, pants, drinks, cars, body parts … Most items struck me as rather excessively priced or ephemeral, but a few choice pieces had me reaching for my Linden dollars, the coin of the realm.
One of my first stops was a store called Dicks and Pussies, where I somehow managed to score a free T skintight, red and white, with the name of the store emblazoned across the chest. It was fine for walking around in an adult boutique, but I couldn’t figure out how to get the damn thing off. What would they say at Club Insatiable? In the hopes of finding a better free shirt, I teleported to a few other stores, but no luck. I was stuck looking like a freebie-grubbing douche bag until Tony could help me. Luckily, we had made a date for that night.
CLICK ON THE BLUE ONE
By 10 p.m., Tony and I were in an alcohol-fueled Second Life frenzy. After scoring some more Linden dollars, we flew around to goofy places like Hedonistic Isle, where you can gamble, listen to streaming audio, and lounge in lawn chairs. There were volleyball courts, bonfires, and beach toys all over the place, but I had other plans. Talking, dancing, and roasting electronic marshmallows were great and all, but what kind of nightlife would be complete without one-night stands?
I felt I had to act. "Hey Tony," I said. "How do you have sex in this place?" Tony stopped tapping at his keyboard and looked me dead in the eye. "I’m not exactly sure," he said. "Why don’t we find out?" I took a sip of my third real Jack and Coke and said, "Follow me."
Besides complimentary dorkwear, Dicks and Pussies has everything your perverted avatar could ever want. For less than a thousand Lindens (about $3) you can get a gigantic schlong with veins or a vagina with hyperrealistic stretch action. There were electric toys, erotic hairstyles, and even peekaboo lingerie. "All right, dude, I’ll buy you a vagina and myself a dick, but you have to show me how to put them on and work them," I said. "Fuck it, why not?" Tony said after a slight pause. That’s all I needed.
Within seconds Tony was wetting things with his brand-new vagina, and I was setting the flesh tones on my penis. "All right, man," I said. "How do you work these things?" I thought we would have to purchase some animation codes or something, but Tony knew a shortcut. Next to the showroom floor was a bedchamber with little balls hovering all over the place. Tony walked up to one and said, "Come on, dude, I’ll click on the pink ball. All you gotta do is click on the blue one, and we’ll be off."
Within seconds Justyn Jewell was balls deep in Tony’s avatar. Hilarious. Tony and I spent the rest of the night drinking and taking screen shots as our avatars explored each other’s software.
I passed out sometime around 2 a.m. and awoke the next morning to a pissed-off girlfriend. "What’s wrong, baby?" I asked. She refused to speak to me for an hour or so and then finally said, "I heard you last night. That was sort of weird that you fucked Tony."
I was immediately assaulted by a flurry of flashbacks: the sound of ice clinking in glasses, the sight of my avatar in the throes of passion, the giggles, the grunts … "Don’t say it like that," I said. "I didn’t fuck Tony. He was just, like, showing me how to have sex so I could buy some later." She stared at her coffee for a full minute and then said, "Well, I don’t know why you have to have sex at all. Is something wrong?"
The more I tried to explain that Second Life was just an entertaining outlet for when I was too busy to take her out, the worse it sounded. Why was I obsessed with that particular aspect of the game, anyway? And why, of all people, did I pick my friend Tony to experiment with? I waited until my girlfriend was in the shower before looking at the screen shots from the night before. Jesus Christ, what a pervert. Thanks a lot, Linden Labs! Now I have two shitty lives to deal with.
My son is among the 800 National Guard members deploying to Iraq this summer, which is why I was at Camp Roberts, near Paso Robles, yesterday afternoon, attending the Family Farewell Celebration.
The scene was as representative of California as any I’ve seen: Brown, black, yellow, and white families, mostly of modest means, judging from the absence of flash cars and flash clothing, and the abundance of baby strollers.
I can’t speak for the other families, but I was biting my lip, trying to hold back the tears and praying to a god I don’t even believe in, as 800 young, and not so young, men marched in formation as part of the farewell ceremony.
There were generals and brigadiers making speeches–encouraging the troops to respect everyone “including the enemy,” acknowledging that they are heading for a tough situation, and advising them how best to come back safe and sound from Iraq.
But there weren’t any elected representatives, except for the Mayor of Santa Maria and an aide from the office of congress member Dennis Cardoza. I found this absence of elected officialdom a tad surprising, given that this is the biggest deployment of the Guard since the Korean War. But then again, perhaps they were all in their home districts, trying to explain to their constituents why the heck the US is still in Iraq.
SONIC REDUCER Where have all the outlaws gone? Now that Paris Hilton seems like the highest-profile sorta-one-hit wonder to run afoul of the law, it’s easy to believe that pop’s rep for rebellion is seriously in question. (And with Warner Bros. jettisoning the overexposed jet-setter, who knows if she should even make the tally?) Yet just how disturbing or subversive is it to glom on to corporate punks like Good Charlotte or hitch your fortunes to soaking-in-it onetime gangstas like Snoop "Soul Gravy Train" Dogg? How revolutionary is it to play music your parents might approve of, à la white-bread soul poppers Maroon 5?
But those petty pop-crit worries wane on hearing about the Coup mastermind Boots (né Raymond) Riley’s Memorial Day misfortune. In the early-morning hours, long before most locals were firing up the grill and chugging microbrews, Riley was looking down the wrong end of a San Francisco Police Department gun barrel while innocently attending a get-together at a friend’s warehouse in SF’s Dogpatch-Waterfront zone. Why? Likely for nothing more than driving while black.
Riley had just parked his car near the warehouse when he was blinded by flashlights, and he realized that he was surrounded by cops. "They were saying, ‘Don’t fucking move, don’t fucking move,’ and came straight at me," Riley told me from his Oakland home, where he had just fed his kids their Sunday breakfast. "They put my hands above my head, searched me, and searched my car, even though they were looking for someone who was stealing tires. You know, if they had a description of a light-skinned black man with a big Afro and sideburns, maybe they should have taken me in. But they were yelling, ‘Are you on probation? Do you have a warrant?’ And every time I said no, they said, ‘Don’t lie to us. Don’t fucking lie to us.’"
Neighbor Hoss Ward had been walking his dog by the warehouse when he spied officers with flashlights lurking between parked cars amid the trash on the street. "I thought that was weird. They didn’t question me, but I’m a white man," he said later, verifying that Boots parked, got thrown against his car, and had guns pulled on him. "It’s not unusual for someone to pull up in a beater car," Ward said. Yet this incident smelled like racial profiling: "That’s what the vibe felt like."
"I walked over there and said, ‘What the hell is going on?’" recounted Riley’s friend Marci Bravo, who lives at the warehouse. Eventually Riley was released, but, Bravo continued, "It was really messed up. We fire off fireworks, burn things in the street, and there’s been no problems with cops. They’ve actually come and hung out before.
"It’s just a nasty case of police profiling."
In the end, Riley said, the officers didn’t even check his ID. At press time, police representatives had not responded to inquiries about the incident, and Riley was planning on filing a grievance with the city watchdog agency the Office of Citizens Complaints, a process that the longtime activist is, unfortunately, familiar with. After a 1995 Riverside performance with Method Man, Riley and kindred local hip-hoppers Raz Caz, E-Roc, and Saafir were pulled over and pepper-sprayed in their car seats following a yelling argument at a club. Then there was the incident during the Coup’s 2006 tour around, ironically, their Epitaph album Pick a Bigger Weapon. Shortly after the tour manager urinated next to a semi at a Vermont rest stop, the tour vehicles were stopped by plainclothes officers who claimed to be surveilling a cocaine deal in the truck. "Half the band woke up with guns in their faces," the Coup leader recalled.
Riley’s experiences in and out of our enlightened for some city bring home the ugly, everyday reality behind the entertaining anecdote with which the Arcade Fire’s Win Butler regaled the Greek Theatre crowd June 2: he was almost arrested for the first time that day when Berkeley police dragged him out of a rec facility for arguing over the use of a public basketball court. "They called for backup and everything," Butler marveled onstage.
"There are stories all the time," Riley offered matter-of-factly. "Everyone knows you used to get fucked with in San Francisco and Berkeley."
"Usually it’s not anything with me specifically being a rapper," he continued. "I might have even more protection because of that. Like at this get-together, somebody came up and said, ‘Don’t you know who this is? This is Boots Riley.’ They might not have known who I am, but they realize this isn’t the regular case where they can do whatever they want." *
ALIGN YOUR CHAKRAS, CAMPERS
Talk to underground trance DJs, and they’ll point to the Harmony Festival as the hot spot forest ravers will be orbiting. Indeed, one of the main organizers, Howard "Bo" Sapper who, along with Sean Ahearn, Scott McKeown, and Jeff Kaus, is putting on the 29th music and camping fest agrees that a healthy, fire-breathing portion of the expected 40,000 at the three-day event will be die-hard burners drawn to the seven-year-old techno tribal night. Sapper also points proudly to the diversity of the musical lineup, including Brian Wilson, Erykah Badu, Rickie Lee Jones, the Roots, Common, moe., and Umphrey’s McGee. "I’m not sure if we’re going mainstream or the mainstream is coming to us," Sapper said, listing the green exhibits and this year’s theme, Promoting Global Cooling. "It’s part of the paradigm shift going on in America."
They gathered May 30 in the Richmond District’s Lee Hou Restaurant to voice their anger and outrage at Sup. Jake McGoldrick, calling him incompetent, unaccountable, hostile to the will of the voters, and a "born liar." They blamed him for everything from potholes to the state of the economy.
Yet a closer examination of why the Citizens for the Recall of Supervisor Jake McGoldrick say they are trying to get rid of the elected official reveals that this campaign is based on just a few controversial issues that animate these two dozen fairly conservative people.
Primarily, they’re mad at McGoldrick for sponsoring Healthy Saturdays, which sought a second day of closing some Golden Gate Park roads to cars, and for his support for studying a Bus Rapid Transit system on Geary Boulevard, which some merchants fear will disrupt their business.
"The problem with Jake McGoldrick is he does not allow us to have our issues," said David Heller, a Geary Street merchant who has led the charge against BRT and who ran against McGoldrick three years ago but has since moved from the district.
"Jake McGoldrick has not been responsive to our needs. He’s not there when we need him," said Paul Kozakiewicz, the Richmond Review publisher whose inflammatory and misleading front-page commentaries "The Case for Recalling McGoldrick" over the past two months have been the main rallying point for the recall effort.
As he spoke at the press conference kicking off the recall drive, Kozakiewicz was flanked by Heller and Howard Epstein, a member of the San Francisco Republican County Central Committee, the only political group to endorse the recall drive so far. Democratic Party clubs have all opposed the effort, as did the San Francisco Democratic County Central Committee on a rare unanimous vote.
McGoldrick and his supporters say this isn’t about accountability but about his policy disagreements with a handful of particularly vocal constituents. "What you have here is some folks who just have to have it their way," McGoldrick told us. "The bottom line is we have a situation where some folks disagree on some issues. But to use this to threaten a politician into backing off these issues is an abuse of the recall."
There’s also an ironic note to all of this: if Kozakiewicz had been more truthful in his high-profile attacks, his readers might know that McGoldrick actually watered down the BRT study to appease the Geary merchants and that he resolved the long-simmering park road closure issue in a way that maintains full auto access to the museums and prevents alternative-transportation advocates from reviving the fight for at least five years, much to the chagrin of many walkers, skaters, and bicyclists.
Recalling McGoldrick would require the valid signatures of 3,573 registered voters from District 1, or 10 percent of the total, according to the city’s campaign services manager, Rachel Gosiengfiao. The campaign has until Sept. 14 to gather signatures, although Gosiengfiao said that if recall supporters want to make the November ballot, they need to submit the signatures for verification by June 22.
If the signature drive is successful and a majority of voters then decide to remove McGoldrick, Mayor Gavin Newsom will appoint a replacement who will stand for reelection at the end of next year, when McGoldrick’s term expires.
"We’re not getting involved with replacing the supervisor," Kozakiewicz said. "We’re going to leave that up to the mayor."
Kozakiewicz’s "The Case for Recalling McGoldrick" started with this description of how the effort began: "In March, a dozen community leaders from a broad cross-section of the community gathered for breakfast at the Video Cafe on Geary Boulevard. The topic of discussion was the district’s supervisor, Jake McGoldrick, and what should be done to limit the perceived damage the supervisor was doing to the City."
He then went through a litany of supposed abuses, presented in a seemingly factual and straightforward way BRT, Healthy Saturdays, various "Attacks on Families and Property Owners." At least, they might appear objective to those not familiar with the details. The approach sparked more interest in the recall.
"This is a new venture for me, so I’m a little nervous," Richmond resident Margie Hom-Brown said at the event before attacking McGoldrick’s Healthy Saturdays stand. "Two-thirds of San Francisco has voted repeatedly not to close the park. He went on year after year and made it his number one priority…. The actions seem to me rather unethical."
Kozakiewicz used the November 2000 vote against park closure to conclude that McGoldrick "ignores the will of the voters" and used a large, bold pull quote to feature the Measure G question and the fact that 62 percent of the voters rejected it. But what Kozakiewicz doesn’t say is that the measure was placed on the ballot by closure opponents trying to defeat Measure F, which called for immediate closure (before construction of the garage that has since been built) and got 46 percent of the vote (a figure Kozakiewicz conveniently leaves out).
Because of the confusing nature of the two measures, it’s impossible to know how many voters wanted permanent closure at some point, let alone the six-month trial period that Healthy Saturdays called for. But Kozakiewicz has no use for such nuance in his conclusions, remarking at our questions during a phone interview, "Now you’re going into shades of gray."
Similarly, he casts McGoldrick as "forcing BRT on [the] district without notification," despite the fact that the project has been contemplated for decades and that it is now being studied with plenty of future opportunities for public input rather than being a done deal created through some secret McGoldrick plot.
In fact, transit advocate Tom Radulovich, executive director of Livable City, said Kozakiewicz’s commentary is misleading in several ways, most notably in that it fails to say that McGoldrick, as chair of the San Francisco County Transportation Authority, actually prevented the BRT study from looking at light rail because of his fears that it would be too disruptive for the Geary merchants.
"The sensitivity of merchant concerns is one reason why the best option isn’t even being studied," Radulovich said. "It’s ironic that he’s being recalled over this. In a way, you could say Jake is kowtowing to the merchants too much and dismissing good transportation options."
Nonetheless, the recall has a decent shot at qualifying, particularly given the fact that the committee has already raised about $24,000, including $5,000 from the Residential Builders Association and $1,500 from the Small Property Owners of San Francisco. It has also hired a firm called JKW Political Consulting, which is not registered with the city as required.
"In reality, the 10 percent threshold is pretty low. Whether you’re paying people or using volunteers, you can get that," McGoldrick campaign consultant Jim Stearns said. "So I told Jake we need to be prepared to fight the recall."
And McGoldrick said he is. "We’re talking here about ultraconservative, right-wing Republicans," McGoldrick said of the recall proponents. "And they’ve said that I vote far more progressively than my district…. But I’m trying to do some things that are good for the entire city." *
