The hardest time

Here are the few undisputed facts in the slaying of Roderick “Cooly” Shannon: in the quiet early-morning hours of Aug. 19, 1989, Shannon piloted his mother’s green sedan past the modest, boxy houses of their Visitacion Valley neighborhood. As Shannon coasted along, a posse of young men piled into four cars and gave chase, careening after him through the darkened streets. At the intersection of Delta Street and Visitacion Avenue, the hunted 18-year-old plowed up on the sidewalk, crashed into a chain-link fence, and fled on foot. He ran a couple of blocks, pounding into the parking lot of Super Fair, a graffiti- covered liquor- and- groceries joint. The mob – about 12 deep – grabbed him as he tried to scale the fence between the store and the house next door.

They pummeled Shannon. Then one of the thugs executed him with shotgun blasts to the shoulder and head.

Police linked Shannon’s murder to a raging war between hood-sters from Vis Valley and Hunters Point. Young people – mostly African American – in the two housing project-heavy districts were waging a bloody battle for control of the drug trade, a battle that had escalated into a string of life-for-life revenge killings.

Homicide cops figured Shannon’s execution was a retaliatory hit for the “Cheap Charlie” slayings six months earlier. “Cheap” Charlie Hughes was a player in the Hunters Point drug business who’d been gunned down on his home turf at the intersection of Newcomb Avenue and Mendell Street in a massive firefight. The attack, thought at the time to be the handiwork of gangsters from Sunnydale public housing, also took the life of Roshawn Johnson and sent nine others to the hospital with gunshot wounds. Shannon’s killers, the San Francisco Police Department contended, either thought he had a role in the Cheap Charlie shoot-up or simply wanted to take a Sunnydale homeboy out of the game.

In the fall of 1990 two young men were locked up for Shannon’s murder and sentenced to 25 years to life in the state penitentiary.

Both men had alibis, and 10 years later both maintain their innocence. There are a lot of reasons to believe them.

The prosecution’s case relied almost completely on the shaky, ever changing testimony of a pair of adolescent car thieves. A new eyewitness says the convicted men had no part in the killing. And in a plot twist straight out of Hollywood, another person has confessed to the crime.

Despite a pile of exonerating evidence, the prisoners remain caged. But one of them – a spiritual, soft- spoken man named John J. Tennison – has an unusually passionate, stubborn lawyer on his side. Jeff Adachi, a sharp-dressed idealist known for winning tough cases, has spent 11 long years fighting for Tennison’s freedom – and isn’t about to give up. This is the story of the lifer and the lawyer who wouldn’t quit.

The 12-gauge shotgun that took Shannon’s life was never found. Immediately after his death, homicide detectives Napoleon Hendrix and Prentice “Earl” Sanders spent three fruitless days scouring the city for clues. The killers left little meaningful evidence at the murder scene – no fingerprints, no footprints, no blood, no DNA.

Then a 12-year-old Samoan girl named Masina Fauolo called, offering eyewitness information. She said nothing about anybody named Tennison. But after months of talking to the inspectors, Fauolo, a pal of the victim who lived a few blocks from the crime scene in subsidized housing, identified Tennison as a key player in the murder. “Fat J.J.,” she said, held Shannon, while a man named Anton Goff blew him away. A few months later Fauolo’s friend Pauline Maluina, then 14, chimed in with a corroborating narrative.

Besides Fauolo and Maluina, no one would admit to having seen the killing.

During the autumn of 1989, propelled by the testimony of the two girls, police rounded up Tennison and Goff and hit them with first- degree murder charges.

Enter Adachi, a tough- talking young public defender. Scoping the prosecution’s evidence against Tennison, he found a case riddled with inconsistencies. He figured his client would walk. “The girls’ stories never made any sense,” Adachi says today. “I really thought this case was a winner.”

The attorney also found a young man who regarded him with deep suspicion. “I’m sure he had a certain stereotype coming in of public defender,” Adachi says. “A lot of it comes from popular media: you always hear that line, ‘Why was he convicted? He had a public defender.’ Within popular culture in the African American community there’s that distrust of anything related to the Hall of Justice.”

“It wasn’t just [Adachi]; it was the whole predicament,” Tennison explains. “I’d never been in that situation – charged with murder.”

Meanwhile, deputy district attorney George Butterworth was building an indictment of Tennison on the words of Fauolo and Maluina. As he did, their stories mutated.

Fauolo’s account of the August 1989 murder, laid out in trial transcripts, went like this: She’d taken the bus from Sunnydale to the corner of 24th and Mission Streets, where she picked up a stolen two-door gray car from her cousin. Fauolo and Maluina took off, cruising through the Financial District, down Mission Street, and north to Fisherman’s Wharf, before heading back to Vis Valley. The kids parked in the lovers lane up above McLaren Park, smoking cigarettes and looking down on the city.

Four cars, full of people Fauolo referred to as “HP [Hunters Point] niggers” – Tennison among them, she said – slid into the lane. After 10 to 15 minutes a green car drove by, speeding along Visitacion Avenue. It was Shannon in his mother’s car, a vehicle usually driven by his cousin, Patrick Barnett. “There go that nigger Pat!” one of the young men shouted. “He going to pay the price now.”

The Hunters Point posse jumped in their cars and tore off after Shannon, apparently thinking they were pursuing Barnett, a suspect in the slaying of Cheap Charlie.

Fauolo and Maluina peeled out, tailing the chase. When Shannon crashed, Fauolo ditched her car by Visitacion Valley Middle School and followed her friend on foot. From the corner of the Super Fair blacktop, standing beneath a Marlboro sign, she watched as the pack, laughing, beat her friend. Goff, whom Fauolo had never seen before, emerged from the crowd, yanked a “long gun” from the trunk of a car, and boasted, “I’m going to blow this motherfucker out!”

“Don’t shoot him!” Fauolo screamed. “Don’t shoot him.”

“Shut the fuck up,” Goff yelled.

Then, according to Faoulo, Tennison held the victim like a sacrificial offering while Goff popped off four or five shots. As the mob slowly slipped away, Fauolo ran to Shannon’s aid. He was lying face up on the asphalt. “Go get Pat,” he croaked. “Go get Pat.” Wearing a T-shirt memorializing a Sunnydale homeboy who’d been murdered a few months earlier, Shannon died.

When Fauolo first contacted the homicide unit on Aug. 22, she made no mention of J.J. Tennison. Throughout the two-and-a-half-hour call with detective Hendrix, the girl said she’d watched the crime go down, but she couldn’t – or wouldn’t – ID any of the participants.

Only after months of talking to the inspectors on a near daily basis would the girl pin the murder on Tennison and Goff.

Yet at the time of the killing, Fauolo knew exactly who Tennison was. He lived on the same Hunters Point street as her cousins. She saw him nearly every Sunday when she visited her relatives. She knew what kind of car Tennison drove. She knew his name.

So why did the girl wait so long to cough up that name, Adachi wondered. “You wanted to bring the people who were responsible for Cooly’s death to justice…. And still you never mentioned J.J.’s name during this [initial] conversation?” he asked Fauolo.

“Because I – I didn’t – I wasn’t ready to talk to him about anything,” Fauolo responded.

Adachi wasn’t buying it. “We thought that the cops had either convinced or at least influenced the girls to identify Goff and Tennison,” he says.

During that first phone call the girl was, however, ready to describe the vehicles that chased down Shannon. One of them, she said, was a yellow-and-white Buick Skylark. The description set off bells for Hendrix and Sanders. Tennison, a known gangbanger who’d been popped a couple of times for selling weed, owned a car matching that description. They poked around for him.

“I heard from a few people the rumor that the homicide detectives were looking for me,” Tennison recounted in a recent Bay Guardian interview. He stopped by the central cop shop at 850 Bryant. “I asked them what was going on. They basically said, ‘Your car and you were involved in a homicide.’ I basically told ’em we can cut this interview short, that my car was in the impound already.”

Towing-company records proved Tennison’s impounded car wasn’t at the scene of the crime, and he was set free.

Still, on Oct. 31, 1989, after repeated in-depth conversations with the police, Fauolo picked out Tennison from a photo lineup. Now, however, she offered new information. Straining the bounds of credibility, Fauolo insisted that Tennison owned two nearly identical, yellow-and-white Buicks: one with a white vinyl top, the other with a white- painted metal roof.

Prosecutor Butterworth never produced any evidence that this second car truly existed. While the SFPD keeps a photo registry of the vehicles of suspected gangsters, it had no snapshots of this mystery car – let alone the actual auto.

At the trial, medical examiner Boyd Stephens told the court that Shannon’s body bore no bruises: the boy hadn’t been beaten with anything but fists. Though Fauolo had sworn in pretrial depositions that the victim had been attacked with bats and sticks, she now said that she hadn’t seen the mob actually striking Shannon with the weapons.

Other aspects of Fauolo’s testimony are troubling. For one thing, she was standing more than 100 feet away from the crime, on a moonless night. Could she really make out the assassins?

Her recollection of the car chase never jibed with that of another witness who took in the pursuit – though not the actual shooting – from his Cora Street window. Shannon and his assailants, this witness said, had been driving in reverse at high speed for at least part of the chase. The victim backed his car into the ballpark fence at high speed, pursued by a black pickup truck “doing about 35 miles an hour backwards.”

Fauolo, who supposedly had a front-row seat to the incident, never mentioned anything about the vehicles reversing rapidly.

Maluina’s testimony – also documented in court records – was even more suspect. In November 1989 the girl was called into her school principal’s office. Hendrix had some questions for her. Yes, Maluina told the detective, she’d seen Shannon get “mobbed” and killed. How had she happened onto the crime scene? She’d been “walking around.” In Maluina’s version of the night’s events, there was no stolen car.

When Hendrix presented the girl with an array of mug shots, Maluina picked out Tennison but failed to ID Goff as the triggerman. She also selected a third man as a possible perpetrator but later retracted that accusation.

Four months later, at a preliminary court hearing, Maluina wasn’t sure Tennison had been among the mob. “I’m not sure,” she said when asked if the boy was one of the killers.

“And that’s your honest answer?” Adachi asked.

“Yes,” the girl replied.

Goff wasn’t there, Maluina told the court at another early pretrial hearing.

In April 1989 Maluina recanted her testimony completely.

She now told Hendrix and prosecutor Butterworth that she hadn’t seen the crime. In fact, she said, she’d fabricated her whole story at the urging of Fauolo. “I wasn’t there when the incident happened,” Maluina told Butterworth. The other girl, Maluina said, had filled her in on the details of the crime, instructing her to single out the “biggest guy” in the mug shot lineup. (Tennison at that point carried about 200 pounds on his roughly five-foot-nine frame.) “The only reason I picked out J.J.’s picture is because Masina told me to,” she pleaded.

His case crumbling rapidly, Hendrix phoned Fauolo – who had moved to Samoa – and put Maluina on the line. By the time the two friends were finished talking, the girl’s story had morphed once again: Actually, she was there, Maluina informed the men.

When the jury heard the case in October 1990, Maluina was steadfast: she’d seen the crime and could pinpoint Goff as the gunman and Tennison as an accomplice. Fear had driven her testimony through its chameleonic changes, she told the court. She hadn’t wanted to be busted for the stolen car, so she’d left it out of her story. She’d recanted her testimony and denied witnessing the crime because she’d feared violent retribution.

Like Tennison’s supposed second car, Fauolo and Maluina’s boosted sedan was never found; either police had failed to track down the hot car, or perhaps it never existed.

The jury, which took three days to arrive at a guilty verdict, believed Maluina and Fauolo.

I pass through many locked steel doors to reach the home of J.J. Tennison.

At the gates of Mule Creek State Prison, two and a half hours northeast of San Francisco in Amador County, I empty my pockets and stand in my socks. A female prison guard, a middle-aged white woman with a gravity- defying shock of bottle blond hair, scopes the insides of my shoes for contraband. “Bleep-bleep-bleep,” shrieks the metal detector as a Latino mom, grade-school kids in tow, passes through. It’s her underwire bra. The guards have her take it off.

I walk through the metal detector without incident. Ahead of me a 12-foot-tall chain-link door slides open. The moment I step through, it shuts behind me, locking me inside of a claustrophobic six-by-eight-foot cage equipped with two security cameras. The cage door pops open, and I walk out into a small courtyard hemmed in by razor wire. I stride across a heat-scorched lawn into another squat cinder-block building.

Here a stoic correctional officer in a green jumpsuit checks me over before unbolting the thick door to the cafeteria- like visiting room.

Tennison, a bulky black man with a freshly shaved head and a bright smile that seems out of place in this drab universe, greets me warmly. He speaks quietly but forcefully, as if this rare face-to-face encounter with the outside world could end at any moment, a soft drawl rounding off the edges of his words. Now 29, he is hefty but not overweight, childhood fat shed for muscle, his complexion coffee- colored, eyes penetrating.

I’ve journeyed here with Adachi, and a palpable tension hangs in the air when the lawyer relates recent developments in the case. The two men lock eyes; sweat beads on Tennison’s tall forehead. Adachi has little good news. “I know it doesn’t seem like we’re doing shit, ’cause you’re still in here,” he says.

The prisoner responds in a near whisper: “It just gets harder and harder every day.”

The youngest of four boys, Tennison grew up “on the hill,” as they say in Hunters Point, on Northridge Street, splitting time between his divorced parents, Dolly Tennison, a shoe salesperson, and John Tennison Sr., a sheet- metal worker at the shipyard. The tough, largely African American neighborhood in southeastern San Francisco comprised his entire childhood world.

At Sir Francis Drake elementary, Tennison recalls, “I was pretty much like any other kid going there: did the work, didn’t like it, played sports.” Physically chunky from an early age, Tennison loved athletics – “any kind of sports” – but football was his game; that is, when he could keep out of trouble. In his teenage years, between two stints in San Francisco’s youth lockups for selling weed, he played linebacker for the MacAteer High School football squad. Tennison the ghetto entrepreneur cliqued up with the Harbor Road “set,” a loose-knit band of teen and twentysomething males who claimed the area around that street’s subsidized apartments as their exclusive drug- slanging fiefdom.

Some days Tennison figures his decade in prison has been a blessing: it beats being dead, and many of his old running mates are six feet under – a half dozen Harbor Road heads were slain in 2000 alone.

To former friends dwelling “on the outs,” he is forgotten: over his 10 years of incarceration their stream of letters has dwindled, their visits have tapered off entirely. Like most lifers, Tennison has gradually become a ghost, a specter of the man his preprison companions once knew.

He doesn’t keep in touch with Goff; he says he scarcely even knew him before they were arrested.

Survival, family, and faith define the con’s existence. Survival in Mule Creek – host to a preponderance of lifers – means keeping your mouth shut and your head down; avoiding the vagaries of “prison politics” by staying in the good graces of the turnkeys and off the shit lists of other inmates; maintaining your sanity in the face of unending repetition. Tennison does not indulge this journalist’s urge to gather stomach- turning details about penitentiary life; he will only hint at the horrors that transpire behind the walls. “Some thangs you just mentally try to block out. I’ve seen a guy get shot. I’ve seen guys get stabbed. It’s a violent place. One minute it’s nice … the next minute somebody’s being carried away on a stretcher.”

In another 14 years Tennison will be a candidate for parole – in theory, at least. The state, from Gov. Gray Davis on down, is allergic to paroling convicted killers, even those legally eligible for early release. And unless that changes, he will never escape the grip of the California Department of Corrections.

What happens to the person buried – along with some of the ugliest, most brutal people on earth – under an avalanche of concrete and steel, alive with only the faintest prospect of rescue?

The weight of long-term incarceration is famous for creating stony- faced sociopaths, but Tennison seems a flat- emotioned husk of a man who – simply, quietly – endures. If truly innocent, he is living out the mother of all nightmares. Yet when I speak to him, I see only the tiniest hints of rage: no fury at the hand fate has dealt him, no profanities for the cops and prosecutors who put him here, no ill will toward the girls who testified against him. He gripes little about his locked- down environs and must be pressed to complain about the conditions of his confinement. “I live very well compared to a lot of other less fortunate people,” he tells me without the slightest touch of irony.

Home is a six-by-eight-foot cell he shares with another man. Amenities include a 13-inch TV, a CD player, and a Walkman. Work is an 18¢-an-hour job in the prison print shop. Recreation is shooting hoops in the exercise yard after work. Nighttime is reserved for prayer. The joys in the inmate’s life are meager: a familiar song on the radio, warm sunlight pouring through his cell window on a chilly day, a phone call to kin.

Family consists largely of mother Dolly and older brother Bruce. John Tennison Sr. died of cancer in 1993; brother Julius doesn’t keep in close contact; brother Mike was shot in the back and killed a few years back. “I lost my brother, I lost my father, I lost my grandfather since I’ve been in prison. Your [cell] door opens, and you know it’s not time for it to open. You know immediately something’s not right. All three times it’s been like that. I pray and pray and pray that nothing happens to my mother while I’m gone.” From his neck hangs a gold cross, jewelry that once belonged to Mike.

Four or five times a week Tennison’s mind flashes back to the moment he heard the guilty verdict. “I was in total shock, disbelief,” he recounts softly. “My whole body went numb. I couldn’t hear for maybe 30 seconds. Couldn’t speak for maybe another 30 seconds. Out-of-body experience – I just couldn’t believe it.

“As long as it’s been, I can remember that day right now as we speak. At times when I’m just sitting back thinking to myself, I remember just hearing ‘guilty.’ And sometimes I think, what if it was the other way around?”

Every single day of the past decade has “basically been the same. Each step ain’t getting no easier. It’s basically the same routine. First thang when I wake: damn I’m still here. I put it in my mind how I’m gonna deal with this day without interrupting anybody’s program, keep anybody from interrupting my program. Physically it’s the same thang. But mentally it’s getting tougher and tougher.”

Like most of this town’s city-paid defense lawyers, Adachi, a Sacramento native, doesn’t conform to the popular, television- inspired conception of a public defender. He doesn’t show up for court in rumpled, coffee- stained suits; isn’t perpetually outgunned by sharp- witted prosecutors; hasn’t been ground down to a state of indifference.

The son of an auto mechanic and a medical lab technician, Adachi is a true nonbeliever, questioning whether a person of color can ever find justice in an American courtroom.

A handsome, slickly dressed man with greased-back hair and a sleek sable Mercedes, he possesses a genius for ripping apart prosecution testimony. Watching him at work – he’s a pit bull in the courtroom – I get the sense that there is nothing in the world Adachi likes more than practicing law.

These days he takes only the toughest cases. He recently represented Lam Choi, the man indicted for offing a Tenderloin mob boss in 1996 in a high- profile, Mafia- style rubout. He is the lawyer for Jehad Baqleh, the cabbie accused of raping and killing 24-year-old Julie Day. If a murder hits the front pages, chances are Adachi will work it, and much of the time his clients go free. Second in command in the office, he has already filed papers to run for the top slot when current chief Jeff Brown steps down in 2002, and many of his colleagues think he’s a natural choice for the job.

But back in 1989, Adachi was a relative newjack, with just three years under his belt as a city-paid defender. The Tennison- Goff trial was the first murder case he worked from start to finish.

Believing the prosecution had a flimsy case, the young attorney didn’t mount a major- league, call-up- every- witness-you-can-find defense. “That’s the only thing I regret: not putting on more of a case. We really didn’t think it was necessary because what the girls said made no sense. It was chock-full of contradictions.”

Goff’s trial attorney, Barry Melton agrees. “We never really believed they had enough of a case to convict these kids,” recounts Melton, now top public defender in Yolo County. “After all, they were trying to hang these guys on the words of a 14-year-old car thief.”

Both defendants had alibis, but both lawyers were loath to put the exonerating figures – black adolescent thugsters – on the stand, knowing they’d play badly to the jury. Tennison, for his part, contended that during the time in question he’d been picking up friends from the Broadmoor bowling alley. Adachi was scared to even admit to the jury that his client had left the house on the night of the killing.

“If they didn’t think these two kids were in a gang, when they saw all the alibi kids, they definitely would’ve,” Melton explains. “It’s been my experience that half the time people can’t remember what they were doing.”

The jury ruling struck the legal team like an industrial- strength electrical shock. “Oh … my … God,” Melton gasped as the verdict was announced; Adachi was speechless as his client wept openly.

Already tenuous, the bond between Adachi and Tennison crumbled. “I wanted to take the stand,” Tennison remembers. “I figured all [the prosecution] could do was say that I was a drug dealer. I felt that I should’ve testified on my own behalf and my witnesses should’ve testified for me. It would’ve eased the pain for me a little.

“After the trial we kind of pointed the finger at each other. When it was all said and done, I felt he didn’t give it his all. I figured I didn’t get off, so he didn’t do his job.”

Adachi, too, felt let down. “I was angry at him because I thought he didn’t help me. I thought he didn’t trust me because I was a public defender. I could’ve found out more about the case had I had more access to the community. If this had occurred in the Japanese community that I’ve been a part of for years, I could’ve gotten down there and found out everything I needed to know. I did all the regular investigation, talked to all the witnesses, talked to his family, all that. But there needed to be an extraordinary effort, not only to solve a murder but to untangle a web of deceit which had been woven by these two girls.”

Sitting in his Seventh Street office, Adachi holds his fingers a millimeter apart: “We had this much trust after the trial.”

Every defense lawyer has watched – sick in the gut – as a client he or she believes to be inculpable is sent to the pen. These are the trials that haunt; Tennison, his face shrouded in darkness, starred in Adachi’s nightmares for many years after the decision.

“The reason he wasn’t acquitted was because the jury was holding the defense to too high a standard,” contends Adachi, who argues that the town’s then- raging gang war “had the effect of really shifting the burden of proof. If I were to analyze it now, in a gang case where somebody’s dead, you’ve got to prove innocence” – rather than simply raising a reasonable doubt.

When a client is found guilty, the public defender nearly always washes his or her hands of the matter, leaving appeals to state-paid lawyers or private counsel. After all, there’s a steady stream of new clients and no funding for lost causes, which is what most appeals are. Adachi conferred with gumshoe Bob Stemi, the investigator who’d helped him craft Tennison’s failed defense. Both men were devastated. They decided to start over, to excavate fresh evidence and reconstruct the case as if they were headed back to trial.

Adachi began reaching out to Tennison, hoping to resurrect some sense of trust.

A month after the verdict came down, S.F. police officers Michael Lewis and Nevil Gittens picked up a man named Lovinsky “Lovinsta” Ricard Jr. on a routine drug warrant. Ricard had a surprise for them: it was he – not Goff and Tennison – who shot Shannon to death, he informed the cops.

According to police transcripts of that confession, Ricard had been cruising around with a bunch of friends in a convoy of three cars and a black pickup truck, looking to leave somebody from Sunnydale bleeding. The posse stopped to loiter in the parking lot of the 7-11 at Third and Newcomb Streets – just a few blocks from the spot where Shannon was killed. Ricard sat in the pickup swilling Old English malt liquor.

Shannon drove by, and Ricard and company lit out after him. When they got to the Visitacion Avenue ball field, Ricard told the cops, Shannon “ran up on the curb, and at the fence he jumped out. Then we started chasing him. I remember I got off the truck and … some people, they had already cornered him, OK…. And they, over there, they were beatin’ him up. They was beatin’ him up.”

Ricard pulled a 12-gauge from the truck and gunned down Shannon, “because we knew he was from Sunnydale.”

“Were any of two individuals, Antoine [sic] Goff or John Tinneson [sic], do you recall whether they were with you on the night this thing occurred?” one of the officers queried.

“No, they were not,” Ricard responded.

There were some flaws in the story. He was fuzzy on some details, like how many shells he’d put in the shotgun and what brand the gun was. He wouldn’t name any eyewitnesses to back up his claim. And he couldn’t provide the murder weapon.

Ricard’s confession was the kind of thing that happens all the time in the movies and almost never in real life – and despite the limits of his story, Adachi assumed Tennison and Goff could start planning their homecoming parties.

The confession turned out to be a bombshell … that never exploded. Judge Thomas Dandurand shot down a request for a fresh trial. Deeming Ricard’s confession unreliable, the police set him free. Legal documents indicate that Ricard now lives in St. Paul, Minn. (Our attempts to reach him through the mail and by phone were unsuccessful.)

On July 2, 1992, nearly three years after the murder, investigator Stemi convinced a witness to step forward. This person, whom we’ll refer to as Witness X for obvious security reasons, gave police, prosecutors, and the defense a detailed rundown of the slaying and the events that preceded it. The new account – which was taped and transcribed – corroborated Ricard’s confession and included the names of four alleged accomplices to the crime. Ricard was indeed the gunman, Witness X asserted. Tennison and Goff had no part in the crime.

Now, Adachi figured, Tennison and Goff would finally walk. Wrong again. Arlo Smith, district attorney at the time, didn’t feel the narrative was strong enough to reopen the case.

Stymied, Adachi kept probing and enlisted the help of private attorney Eric Multhaup in navigating the maze of court appeals.

Tennison and Goff “had nothing to do with it,” Witness X tells me in a recent interview. “Lovinsta even got up and told that he did it, and that neither J.J. nor [Goff] had anything to do with it. I do know what happened – I was there.”

Over the course of a two-hour conversation Witness X offers a convincing recounting of the crime. “Lovinsta went over there while they were beating him up,” shot Shannon, and “came back with his shirt and everything all bloody and said it felt good.

“Lovinsta asked us never to say nothing; everybody was to be quiet,” the informer tells me. Adachi hired an ex-FBI agent to run a polygraph test on X; according to the machine, the witness is telling the truth.

Witness X claims – as police had theorized – that Shannon was killed to avenge the deaths of Cheap Charlie Hughes and Roshawn Johnson. “It was just anybody at random, whoever it is from Sunnydale, you’re gonna die. Unfortunately, Roderick was right there, and he happened to be from Sunnydale.”

Anton (pronounced “Antoine”) Goff is among the 5,800 humans stuffed into the Corrections Department’s Solano County facility, a strip-mall McPrison built for just 2,100 inmates. It’s luxurious compared with his old digs: Goff spent his first five years on 22-hour-a-day lockdown at the infamous Pelican Bay state pen.

The detectives pegged Goff as a man with a clear motive to murder: he’d been wounded – allegedly by a Sunnydale head – in the Cheap Charlie shooting.

But Goff, now 31, claims he was hanging out with “four or five” buddies on the night of Aug. 29 and never even left Hunters Point. “All of ’em was ready to testify,” he says.

Ricard “was a friend we knew growing up in the neighborhood. He wasn’t nobody I hung around with all the time,” Goff relates, saying he’s positive of the man’s guilt. “He told me everything what happened. He told me personally before I was arrested.”

Tennison was a friend, but not a close comrade, Goff says.

He works out three, four hours a day, playing basketball, sometimes handball. There are no weights in the exercise yard, so Goff builds muscle by lifting other inmates. He studies business, planning for a career that may never come. “You have to be tough to get through the situation, ’cause it’s not easy up in here. You have to have your mind right, or you’ll go crazy.”

Constantly, he asks himself, “Why am I here? Why am I being punished?”

Inspectors Hendrix and Sanders spent better than two decades trying to staunch the city’s bleeding. Both African American, the men staffed the homicide unit throughout San Francisco’s goriest years – the crack- fueled murder binge that ran from 1985 to 1993 – digging into some 500 slayings and solving 85 percent of them. As a team they were the kind of hard-boiled, damn near inescapable cops dreamed up by TV scriptwriters.

These days, 63-year-old Sanders, now assistant chief, seems more grandpa than hard-ass. His mind, however, is anything but soft: talking about Shannon’s execution, he effortlessly calls up minute details from the decade- old incident.

Sanders is indignant at Adachi’s allegation that he and Hendrix might have somehow shaped the statements of Maluina and Fauolo. “That is absolutely untrue. It’s speculation on his part,” the veteran officer tells me. “At no time in my career did I intentionally or unintentionally influence a witness.”

Maluina and Fauolo, the ex- detective insists, “had no axe to grind. They were reluctant to come forward because they had families in the community,” but through many hours of dialogue the cops convinced the girls to take the stand.

“Eyewitnesses all the time have inconsistencies,” he says. “And those inconsistencies were pointed out by the defense counsel, very thoroughly. But those inconsistencies were not enough to shake the judgment of the jury as to the guilt of the two young men.”

Maluina’s flip-flop signified an instinct to protect herself, not dishonesty, Sanders argues. “She was afraid. Witnesses get killed. She was frightened, and rightfully so.”

For Sanders the testimony simply made sense – agreeing with the few clues discovered at the scene. He remains adamant about the girls’ integrity.

I ask about Tennison’s supposed second car, the one that never materialized. Irrelevant, according to Sanders. “I looked at the evidence carefully. We didn’t investigate this overnight. As far as I’m concerned, we laid out the evidence, gave it to the prosecution, which presented it to the jury – and the jury agreed that these two young men were guilty.”

So why would Ricard cop to an assassination he didn’t do? Would an innocent guy really volunteer for a permanent stay in the joint? “I have no idea what his motivation would be – except for pressure from some of his gang members. I don’t doubt that he may have been there, but the information he gave doesn’t fit the scenario.

“I initially thought [the confession] was just to confuse the issue, because he did not have the details of what happened. We know exactly the route of the chase. We know what corners – we know where the car was crashed. He didn’t know all that. I don’t know why he came forward. I have no idea.”

Tennison and Goff deserve the purgatory they now dwell in, the cop assures me.

(Hendrix, who retired in 1999 after 34 years on the force, declined to be interviewed for this story.)

Silence governs the urban underworld. Rule one is: you do not snitch. Rule two: Breaking rule one is a transgression punishable by death. Case in point: two witnesses in San Francisco murder cases were slain just in the last two months.

Witness X named three other supposed witnesses, and Adachi’s archaeology has focused on unearthing these characters. Scouring credit data, Department of Motor Vehicles info, court records, and prison rolls, Adachi, along with investigator Stemi, hunted up two of these people, only to run head-on into the code of the streets. Bringing along a tape of Ricard’s confession, Adachi and Stemi paid a visit to one of the alleged witnesses, a convicted dope dealer doing time in the San Quentin state pen. See, they said, your buddy turned himself in; he’s trying to take responsibility for his actions. No dice, the man replied. I don’t got shit to say to you.

Contacting another alleged witness (this one a small-time rapper) via a trusted intermediary, they again came up empty. It didn’t matter that Ricard had already incriminated himself: nobody wanted to talk. Besides, Shannon had been besieged by a mob, and flapping lips could conceivably lead to more arrests. There is no statute of limitations on murder.

“All of them are scared that they’ll go to jail,” Witness X figures.

Since the trial, Maluina and Fauolo have made themselves scarce – both have moved in and out of San Francisco on several occasions – eluding attempts by Adachi and Stemi to reach them. (The Bay Guardian was unable to contact either woman.)

Despite all of the dead ends, Adachi and Tennison have, if anything, grown closer, writing letters and speaking on the phone every couple of weeks.

Adachi keeps the Tennison- Goff trial transcripts next to his paper- covered desk. His notes on the case are jammed into a dozen overstuffed binders lining an office bookshelf. The trial exhibits are stacked in a corner. He and Stemi still discuss the case two or three times a week.

Adachi is amazed at Tennison’s resilience. “I’ve seen him mature into a very spiritual man. For him to be as strong as he’s been – that’s what hits home to me now. How could he stand up to that?”

“I not only think of him as my attorney,” Tennison says, “but I consider him a good friend who’s giving his all to get me out. I think of him as a damn good friend.”

Adachi tells me he “will never, ever give up” on his client. “I don’t care what it takes. I could be 80 years old. I’ll never give up.”

It’s a commitment that has won him praise from his peers. “You’re not going to find too many lawyers with the heart Jeff Adachi has,” ventures Scott Kauffman, a private defense lawyer who specializes in gang cases and death penalty appeals. “I definitely think he’s doing it for J.J., but at another level it’s personal. This case has caused him a lot of pain. I’ve seen him talk about the case – he’s almost in tears.”

Goff’s attorney, Melton, lauds his former cocounsel: “He’s been steadfast. Given the information about the case, you have to remain committed.”

But what if Adachi’s instincts are wrong, and Tennison did murder Shannon? If so, Adachi has wasted 11 years attempting to unchain an assassin.

To keep from obsessing over her son’s fate, Dolly Tennison works herself to exhaustion. Mornings, she clerks at a department store; nights, till 4 a.m., she attends to an ailing 83-year-old woman. Seven years back Dolly fled to a small, solitary apartment on the peninsula. Hunters Point was tainted with “too many damn memories.”

Dignified, her clothes and medium-length hair immaculate, Dolly looks like she’s working very hard to keep her chin up, to keep darkness from closing in. Given the age of her children, she must be approaching senior citizen-<\d>hood, but she looks trim and healthy.

“It hurt like hell for them to say 25 to life for my child,” she tells me, her words rushing out all at once, only to trail off just as quickly. Portraits blanket the walls of her home: chubby Buddha babies; a granddaughter in prep-school togs; son Bruce on his wedding day; J.J. in prison blues; murdered son Mike looking hard.

Dolly beckons me to take in the snapshots from her vantage point on the couch. “I think I’ve been glued to this spot since Mike died. I can sit here and see all my family. I’ll sit here all day long waiting for [J.J.] to call as long as I can hear his voice,” she tells me, pointing to the photo of her dead son, “<\!s>’cause there’s one over there I can’t touch.”

Like the parent of a long- disappeared child, she holds out an almost irrational hope that her son will one day emerge from exile. “My best day is when I go visit my kid. It’s hard knowing my child may not be coming home soon, but he’s gon’ come home.” Dolly is her son’s rock; prayer, she tells me, is her anchor.

Slowly shaking his head, 34-year-old Bruce, a San Francisco parking lot attendant, raises his voice. “I understand that it’s been 10 years outta his life, but it’s been 10 years outta my life, too, 10 years outta my momma’s life. Gone. Can never get back.” Enraged, he blames the legal system for his brother’s lot.

Bruce daydreams about the day his younger sibling is liberated: “He’d just call me and tell me what he’d wanna ride home in. Budget’ll rent anything – a limo, an R.V., whatever. I want just to ride and talk with him – free. No doors closing behind us. The wind blowing on our little bald heads. Seeing the sun rise and the sun set.”

On a mid- November morning, the 9th U.S. Circuit Court of Appeals, the highest- ranking federal court in the western United States, will hear Tennison’s plea. The judiciary hasn’t smiled on Tennison’s appeals: four courts have vetoed his bid for a new trial. The last rejection – by a federal district judge – came in March, leaving Adachi “gutted” and Tennison dejected.

The 9th Circuit’s Mission Street courtrooms are housed in a stately $91 million granite edifice – the interior all marble and polished wood. Inside courtroom three, a pristine chamber worthy of a Tennessee Williams drama, hangs a tile mosaic depicting a freed slave, shackles snapped, approaching a white Lady Justice on bended knee. Beneath the image, on a walnut pew, sit Dolly and Bruce Tennison.

Dolly, dressed for business in a black pantsuit, clutches a form letter from the court: Adachi’s ally, attorney Multhaup, will have 10 minutes to argue before the bench. Bruce throws an arm around his mother’s shoulders. Eleven years in prison, and J.J. Tennison’s fate – whether he will spend the rest of his days behind bars – rests on a 10-minute conversation and a legal brief. Multhaup’s argument today is simple: the lower federal court has abandoned its constitutional duty by refusing to review new evidence in the case.

“We have a claim here that the petitioner is presenting new evidence of factual innocence,” Multhaup tells the panel somewhat nervously.

“But the state courts reviewed this evidence,” one judge replies.

“We had a preemptive strike by the [federal] District Court. The [S.F.] Superior Court that dismissed the case was in no way reasonable, in my opinion. And how many times does this happen in the criminal justice system? We have a person who’s come forward and confessed to the crime.”

The judges launch a fusillade of questions at Multhaup, at one point rattling him a bit. In 10 minutes the hearing is history.

Outside the courtroom the Tennisons, solemn faced, huddle with Multhaup. The attorney plays the optimist, while Diana Samuelson, the lawyer handling Goff’s appeals, is less sanguine, telling me she thinks the circuit will kill the petition.

Prosecutor Butterworth would not speak to the Bay Guardian for this piece. He did, however, fax a one-page rebuttal to Tennison’s charges, which reads in part: “This matter has been reviewed several times by the office of the District Attorney and the San Francisco Police Department based upon the allegations raised [in Tennison’s ongoing appeal]. Nothing has been presented to date that would justify ‘re-opening’ the investigation.”

Grilling Tennison, I look for cracks in his story, telling slipups that might point to his guilt. His account of the night in question – that he was sleeping at a friend’s house, then picking up pals from the bowling alley – corresponds to what he told detectives 11 years ago as they ran the good cop-<\d>bad cop routine.

Why would Fauolo and Maluina lie and put away an innocent man, I ask.

“Over the years I’ve asked myself the same question and still haven’t come up with an answer,” he tells me. But “right out the gate it was no doubt in my mind that the homicide inspectors, the D.A., or somebody put ’em up to this, because I knew they were pointing out the wrong person. As for [Goff], at the time I wasn’t sure, but I was definitely sure that they had the wrong person when they pointed out me.

“I’ve said it from day one: I’m not a murderer. I was a drug dealer at the time. It wasn’t nothing to be proud of, or ashamed of. I was locked up for it twice. I did my time.

“In a time when you want people to believe in the justice system and that the system works, I’m a perfect example that the system is screwed up – from the top to the bottom. And as of right now I can’t see it no other way. Everything is in black and white.”

Tennison is relaxed, coming off like a man who can’t be bothered to front, as I put him on trial all over again. Maybe he’s guilty as hell; maybe he snuffed out Shannon’s young life. But if so, his body language and speech patterns offer no subtle indications of that. When Tennison was picked up by the SFPD, Hendrix and Sanders interrogated him for hours, without a lawyer, and his explanation of the crucial hours never wavered. I wonder if something in his 17-year-old demeanor spelled out “executioner” to the homicide detectives.

I put the question to Sanders. “I worked over 500 murder cases,” the veteran lawman responds. “I’ve talked to a lot of killers in my day, and if I had any indication that he was innocent, I would’ve let him go.”

Uncomfortable playing Solomon, I run Tennison’s story by an old ex-con who spent 25 years in some of the state’s most notorious lockups. “Every guy inside will tell you he’s innocent,” I tell him. “And every bleeding-heart journo wants to believe him.”

“Yeah, but you know, after 10 years or so inside, it becomes really hard to lie,” the former prisoner responds. “You just get so tired, so worn down, it’s impossible to keep up a lie.”

Never mind the fact that Tennison passed a polygraph test.

The 9th Circuit’s ruling arrives in Adachi’s mailbox Dec. 15. He reads through the five-page decision with his heart in his throat. The key information comes in the last two paragraphs: “Tennison’s conviction appears to rest largely on the testimony [of two little girls]. Tennison’s new evidence, taken together, calls into question the reliability of these eyewitness identifications.”

And then, two sentences later: victory. The judges are overturning the ruling of the lower court, instructing federal judge Claudia Wilken to mount a “thorough review” of Tennison’s situation.

It doesn’t mean the inmate is going home tomorrow, nor even that he’ll necessarily get a new trial, but the decision does require Wilken to examine the sworn statements of Ricard and Witness X and to determine whether a retrial should be ordered.

Adachi is elated. Dolly Tennison seems relieved, as if she can finally start breathing again. Bruce Tennison feels like “Christmas came early.”

An upbeat John J. Tennison phones me. “I finally had three judges look over the case and see what should’ve been saw a long time ago.”

Grinning today, the prisoner has already begun steeling himself for rejection at the next round. “I play a lot of basketball to take my mind off it. The [courts] are playing God. My life is in other people’s hands, and there’s nothing I can physically do. Nothing.”

It’s a pleasure to see Sean McFarland receive the Baum Award for Emerging American Photographers. Last August, McFarland was one of the eight artists or groups showcased in the Bay Guardian‘s second annual photo issue. The Baum Award is a national honor designated for photographers at a pivotal point in their development, and in McFarland’s case, that development is the opposite of predictable. While many photographers work toward "dazzle ’em" displays of technical virtuosity, McFarland has moved away from earlier saturated digital color images toward simple Polaroid photos that possess ominous allure.

Did I say simple? McFarland’s dreamlike images of weather and landscapes are only simple in appearance — they require subtle combinations of photography and the increasingly popular practice of found-image collage. In terms of subject matter, they personalize and miniaturize the vast and unsettling images of the semi-settled West present in the camera art of Michael Light, David Maisel, and Trevor Paglen. The title of Lindsay White’s current show at Ping Pong Gallery, "A Field Guide to the Atmosphere," might just as well apply to McFarland’s work. The atmosphere is stormy, and as troubling as it is beguiling.

SFBG In the last year or two, your work has shifted away from urban views to elemental images: sky, sea, vast land. What has set you off in that direction?

Sean McFarland I’ve been thinking a lot about the ways in which the earth changes. In an urban environment, we build buildings, roads, and parks, changing the landscape. These are immediate and obvious alterations of our environment. Our actions also change the landscape as we alter the climate — more frequent and powerful storms, rising seas. By focusing on making images of the natural world, of the landscape, I’m interested in making pictures of us. How we change the earth and how the earth effects us.

SFBG Your work from the earlier 2005 era reminds me a bit of a short film, site specific_Las Vegas 05, by an artist named Olivo Barbieri. It has amazing colorful aerial views of Las Vegas in which the city really looks like it is comprised of toy buildings and cars. Were you looking for that kind of "making strange" effect when presenting views some might take for granted?

SM The work I was making from 1999 until around 2002 tried to take things that were fake and make them look real. When I first started re-photographing the collages I was making (in 2003), the miniaturization effect was an unexpected but welcome result. I was working in the other direction, making the real look fake. The collages are made by hand, so the edges are rough and messy. The selective blurring of images was there at first to hide where the images were put together, but it was that transformative quality of the focus that made the process intriguing to me. With the collaged images, I was taking pictures from all over, real images of real things, and by bringing those disparate elements together, the pictures raise questions about what was actually in the photograph.

The image of the park (in the Guardian‘s August 2008 Photo Issue), for example, has the playground from Dolores Park, but with the downtown skyline and bridge removed and replaced with a sky from another city. It may be the absence of the urban center normally in the background that makes the picture seem odd, or it could be that the light from the sky is not the same reflecting off the foreground. The relationship between fact and fiction is one of the strongest reasons I work with photography as opposed to other visual art forms.

SFBG You mention collage as a part of your process. That might not be so apparent to someone who casually glances at your photography. Can you tell me a bit about your approach to collage, and also if there are any collage artists whom you especially like?

SM Lately I’ve been working to make the collage process less apparent. In the past, the images took the final form of a C-Print, made in a darkroom. Now I’m using Polaroid film. Polaroids are mementos and souvenirs of moments, places, and things that actually happened; they imply that whatever is in the picture was witnessed, was real. Since I can’t really take the images I’m making, I’m using collage to do so. A good example is my image of the airplane flying over the black ocean and white land. The picture of the plane is taken from a satellite image of Earth, the land is a photograph I made in the Exploratorium (it’s a picture of an exhibit that shows how land is changed by wind currents).

SFBG Books are a big visual inspiration to me, so I liked seeing you cite the Field Guide to North American Weather and Gerhard Richter’s Atlas as two recent sources of fascination and perhaps material. What drew you to those books and what do you like about them?

SM I enjoy those books because they are both wonderful collections. I work from an archive of several thousand images. This is probably why Atlas is so fascinating to me. It’s the source material (mostly photographs) that Richter uses in his work and it made me even more interested in his work. I like the Field Guide because all the pictures in it are of weather-based natural phenomena. Some of the photographs in it are pretty hard to believe, but actually happened.

The news from Rock Rapids: Shinny’s funeral

Shinny during his years as chief of police in Rock Rapids, Iowa, during the l950s. This was the card I had in my billfold when I heard about his death. He was technically “Shene” but he was Shinny to me. Shinny approved of my pronunciation. His last card omitted a key word from his earlier cards: “lover.”

The funeral services for Elmer (Shinny) Sheneberger, the central figure in the famous Halloween caper of 1951, were held Friday March 20 in the Congregational Church in Rock Rapids, Iowa.

I got word from Marj and retired CPA Jim Wells and Shinny’s nieces Audrey and Margo Wallace that Shinny had died on Saturday March 14 in his suburban mobile home in Phoenix, Arizona. He had fallen the day before and was found 20 hours later. He was terminally ill with cancer but hanging on.

Shinny was born and raised and lived his entire life of 92 years in this little northwest Iowa town. He was what every small town needed and cherished: an authentic good-natured character who went on generation after generation. He was somehow always there, when you needed him and sometimes when you didn’t. When a politician came to town, the word would get around that Shinny was briefing him at the Lane Cafe. When the Hermie Casjens gang rolled a loaded boxcar across Main Street, twice, on Halloween eve in 1951, Shinny was on duty as chief of police and had to move the boxcars off the street.

I never told Shinny who was involved in the incident and he never asked. Finally, years later, I gave him the full story. He laughed and said, “Let’s drink to it.” We did and did all through the years. When he would call me at my office in San Francisco, he would say, “I want to speak to Bruce. This is his parole officer in Rock Rapids.” Shinny had a wonderful way of operating on Halloween: he would just come upon the roving Casjens gang, and would just shine his car lights. We would scatter and he would move on, never making an arrest. In fact, I don’t think he ever made many arrests, that night or on any other Halloweens. His was humane law enforcement, Rock Rapids style.

Shinny did roll the boxcars back off of Main Street, but we never knew exactly how he did it. He explained in detail at our 55th class reunion last June in Rock Rapids. We invited Shinny to come after Dave Dietz and I got firm assurances that the statute of limitations had run and we were free to talk about the incident. We surmised that Shinny had gotten everyone out of a nearby dance at the Community Building to move the cars. No, he said, he rousted people out of the nearby movie theater under threat of “arrest” and pressed them into action, twice.

Shinny was quietly generous. He owned a farm near town and he told me that he was would be willing it to Camp Foster, the YMCA camp on nearby West Okiboji Lake where many of us went to summer camp. “I always thought highly of the boys who came out of that camp,” he told me. “And so I thought that would be a good place for my farm.”

Through the years, Shinny would say to me, “Bruce, you and I have got to get along together. We’re going to be together for a long, long time.” I never could figure out what he was talking about until I was out visiting the Brugmann plot at the Riverview Cemetery, the picture postcard cemetery atop a hill overlooking the Rock River. I noticed that the plot next to the Brugmann plot was the Sheneberger plot. As usual, Shinny was right.

Here is the email note I sent to my classmates on our email tree for the Dream Class of 1953 (16 boys, 16 girls, now many less):

Shinny’s funeral will be tomorrow (Friday) in the Congregational Church in Rock Rapids.

I ordered a bouquet of red tulips for the service from the Flower Village, with a note “from the Brugmann family and the Class of 1953.” I assume I don’t need to go over the details once again about Shinny’s connection to our class and his involuntary participation in our class activities and the famous Halloween incident of 1951.

Shinny was a longtime member of our church. He always wanted to live as long as Henry Rahlk, also a member of our church, who lived to be 102. Shinny, alas, only made it to 92.

I always enjoy buying my flowers from Flower Village, which once was in the old Brugmann’s Drugstore building. It’s now across the street in the old Bernstein department store building. Each year on Memorial Day, I phone in to Flower Village and buy potted flowers for all the members of the Brugmann plot at Riverside Cemetery. That’s both sets of my grandparents (Ethel and C. C. Brugmann, founder of Brugmann’s Drug in l902; and Allie and A.R. Rice, a Congregational minister in several small Iowa towns); my mother and father (Bonnie and Conrad Brugmann, who was a partner with my grandfather in the drugstore from the Depression onward); and my aunt and uncle (Mary and Clarence Schmidt, a veterinarian from Worthington who was the family representative in World War II.) I hope to end up in the Brugmann plot with my wife Jean.

And the Village people put the flowers on the plot, always well positioned and blooming nicely. Shinny’s family had the next plot and he would always take pictures of my potted flowers and send them to me with a friendly note about “staying in touch and getting together someday.”

And then I would always call the former Janice Olsen to remind her to pick up the flowers and take them to her home in Rock Rapids, once the home of her aunt and uncle, Edna and Harold Jongewaard. Harold was a funeral director in Rock Rapids for many years and buried almost all of our family in our plot. Janice’ s mother was Elsie Olsen, Clarence’s sister, and the Merl Olsens had a family farm out near Edna that I used to visit when I dated her in our junior year.

I didn’t mean to ramble on so long, but Shinny’s death reminds me once again of how it was and still seems to be back there in Rock Rapids, the best little hometown in the country. There are lots of good connections and lots of good memories, but they grow dimmer and dimmer.

So long, Shinny. I’ll be seeing you soon. B3

Sit-Down Specials: Adventures in Asian Crêperies

While discussing what sort of special place to sit down at, Diana had a hankering for the light, salty dishes of Japantown, but Laura was craving the rich, warm crêpes served up at Portland’s Le Happy. A compromise seemed out of the question. Yet a quick Google search revealed that in San Francisco, no cultural divide is so wide that it cannot be bridged by food. For there is, in fact, a crêperie in Japantown. Our curiosities piqued, we set off in the same direction to satisfy our divergent appetites.

On the second story of the Japantown mall we found Sophie’s Crepes, its sign partially obscured behind the bowed, flowering branches of faux cherry trees that sprout up out of the atrium. Past the clouds of pink blossoms and the plastic crêpes showcased in the window (a standard Japantown eatery practice), Sophie’s shows no frills in the airy, sunny space, distinguished by floor-to-ceiling windows at the back of the shop that overlook cars swishing along Geary Blvd.

GREEN CITY Public transit agencies in the Bay Area are being hit with deep cuts to their operating budgets, thanks to the recent state budget deal, and are hoping to use money from the federal economic stimulus bill to maintain their operations.

That conflict played out during a Feb. 25 hearing by the Metropolitan Transportation Commission in Oakland, the agency that distributes federal transportation funds to the nine Bay Area counties, which was considering how to distribute $341 million in funding intended for public transit agencies and $154 million for road projects.

Caltrain, AC Transit, Bay Area Rapid Transit, the San Francisco Municipal Transportation Agency, other Bay Area districts, and transit user groups urged the MTC board to direct most of the money to immediate needs rather than long-term projects.

Community groups urged the MTC to abandon plans to use $70 million for BART’s Oakland Airport extension and $75 million for the Transbay Terminal rebuild in San Francisco.

“People who are most affected when Muni makes fare increases and service cuts are people who are transit-dependent,” said Razzu Engen, who represents the Tenderloin Housing Clinic and the Transit Justice Project. “You can have the best capital expansion project there is out there, but if you don’t have the money to run it, forget it, it’s not worthwhile.”

While the MTC voted to remove the Transbay Terminal expenditure — noting that it could tap into a separate pot of $8 billion for high-speed rail projects in the stimulus measure — they kept the BART extension project in place, leaving $271 million to be divided among the transit agencies.

“Our ongoing need is to maintain continuing operations. But maintenance doesn’t have a very big constituency on the commission. We have a firm commitment to capital programs,” MTC spokesperson Randy Rentschler told the Guardian.

Judson True, spokesperson for the San Francisco Municipal Transportation Agency (which operates Muni), said the money will help offset state funding losses of $61 million over the next two years and allow the agency to “rehabilitate the system.”

Among the expenditures approved by the MTC was $11 million to install 67 new Muni ticket vending machines and money for new Muni vehicles and rail interchanges.

Jose Luis Moscovich, executive director of San Francisco County Transportation Authority, supported the MTC’s decision. “[We’re] going to see money flowing through formulas to Muni to alleviate service conditions on the T-Third, N-Judah, the L.”

Moscovich maintains that the region “needs to take the opportunity of the stimulus package to do things that are going to change the way we live. Paradoxically, these big projects like the Transbay project are the things that are going to take us in that direction.”

Yet the removal of the Transbay Terminal funding, while upsetting to Sup. Chris Daly — who serves on both the MTC board and the Transbay Joint Powers Authority board — turns out to be even more complicated than it seemed at the time.

The San Francisco Chronicle reported March 2 (“Transbay high-speed rail station hits a snag”) that both the California High Speed Rail Authority and Caltrain — systems expected to share the new Transbay Terminal rail terminus — are now expressing doubts about whether they will use the facility after all because of design flaws with its rail component.

CHSRA chair Quentin Kopp was quoted as saying, “Three sets of engineers met and concurred that the design for the station was inadequate and useless for high-speed rail.”

TJPA spokesperson Adam Alberti, who has been sparring with Kopp in recent months over whether Transbay will be the terminus for a high-speed rail system extending from San Francisco to Los Angeles (see “Breaking ground,” 12/10/08), told the Guardian, “I don’t think it’s as bad as it sounds.”

He said the TJPA is currently working to resolve the engineering problems and handle the increased volume expected from high-speed rail and Caltrain and he hopes to have a solution in place by March 12, when he said the MTC will revisit the matter.

BART General Manager Dorothy Dugger also defended the Oakland Airport extension, telling the Guardian, “The challenge in transit is not one over the other. We need to address all those requirements if we’re going to end up with an effective, functioning system that continues to attract people out of their cars and into the smart environmental choice — which is public transit.”

ESSAY/REVIEW There is a wry but hilarious scene near the very end of Roberto Bolaño’s novel 2666 (Farrar, Straus and Giroux; 912 pages; $30), in which a French literary critic finds a German writer, Archimboldi, lodging at what the critic calls "a home for vanished writers." After checking into a room at the large estate, the elderly vanished writer wanders the grounds, meeting with the other vanished authors, residents whom Archimboldi finds friendly but increasingly eccentric. Gradually it dawns on Archimboldi that all is not as it seems. Walking back to the entrance gate, he sees, without surprise, a sign announcing that the estate is the "Mercier Clinic and Rest Home — Neurological Center." The home for vanished writers is an insane asylum.

As we enter the Obama era, with all its promise of "change," I’ve found it impossible to read 2666 without being haunted by the memory of those who vanished into the lunatic asylum of the long George W. Bush years — not just the nameless and unlucky left to rot in the Bush administration’s secret torture cells throughout the world, but also those who disappeared right here at home. For instance, a guy I worked with a couple of years ago. One day he was training me on the job, and a week or so later he was in a federal prison, labeled a "terrorist" — which in his case meant that he edited a Web site called Stop Huntingdon Animal Cruelty.

There were other ghosts, those who vanished after refusing to speak to grand juries. They were rumored to have gone over the border, or back to the land, or who knows where, their very names now superstitiously verboten to speak out loud, lest we bring the heat down on ourselves. Now that Obama is here and everybody is eager for "change," who will remember the once-bright hopes and dreams of the generation that beat the World Trade Organization in Seattle at the dawn of this decade — the hopes that would later be chased down and gassed and beaten by riot police under cover of media blackout in the streets of Miami, St. Paul, or countless other cities? Of course, there were the suicides and overdoses, and other kinds of disappearances, different but related, too: the abandoned novels, or the guitars taken to the pawnshop. Three people in my community jumped off bridges. Only one survived. The human toll of the Bush years in my life has been enormous.

Watching the celebrations in the streets of the Mission District on election night in November, I could tell all of this was soon to be trivia. I saw a virtually all-white crowd of completely wasted people take over the intersection at 19th and Valencia, shouting "Obama!" and dancing in the street. In one way, this scene was touching: the spontaneous gathering was a product of the true feelings of human hope that people have for a better world. Yet the moment already had the scripted feel of something self-conscious or mediated, like the Pepsi ad campaign it would soon become. I had a sinking realization: those of us who have spent eight years battling the post-9/11 mantra of Everything Is Different Now were now going to soon be up against a new era of, well, Everything Is Different Now.

The narratives we tell ourselves about our country are important. Just when a Truth and Reconciliation Committee is most needed to write a detailed narrative of the Bush era’s torture, spying, illegal war, and swindling, I could already see the opportunity for that kind of change slipping away into the blackout amnesia aftermaths of the street parties taking place all across the nation. The election of a president of the United States from among the ranks of the nation’s most oppressed minorities has offered the country a new triumphant storyline. We have symbolically redeemed our sins against civilian casualties and third world workers, without too much painful self-examination. I could see that Obama’s brand of change was really so seductive because it offered a chance to change the subject.

Like Ronald Reagan, elected while the U.S. was mired in recession and post-Vietnam soul-searching, Barack Obama developed campaign narratives that made the U.S. feel good about itself again. Obama guessed correctly that national morale is low partially because we don’t want to deal with the nameless guilt we feel from the atrocities Bush and company committed in our names. Accordingly, he stated during his campaign that he would not pursue criminal prosecution of members of the Bush administration. Nor has Obama questioned the preposterous idea that we can win either a War on Terror or the war in Afghanistan. If you think about it, "Yes We Can" — his campaign’s appeal to good old American can-do spirit — isn’t far off in substance from Bush’s faith-based convictions about U.S. power. Both Bush’s crusade to make democracy flower in the desert of Iraq and Obama’s notion that the auto industry could save itself — and the planet! — with electric cars are fantasies that appeal to our sense of pride about being the richest and most powerful.

When a country that is owned by China and is getting its ass kicked simultaneously by ragged guerilla armies in two of the most impoverished and backward parts of the world keeps finding new ways to tell itself that it’s the richest and most powerful country, it is in deep trouble.

When political leaders and journalists seek to generate false narratives for our consumption and comfort, the difficult task of remembering the truth falls to literature.

Roberto Bolaño completed 2666 in 2003, shortly before he died, too poor to receive a liver transplant, at the age of 50. Born in Chile, Bolaño counted himself a member of "the generation who believed in a Latin American paradise and died in a Latin American hell," and was himself something of a vanished writer. Briefly jailed during the 1973 coup in which Gen. Augusto Pinochet overthrew the popularly elected socialist government of Salvador Allende, Bolaño wandered in exile from Mexico City to Spain, working variously as a janitor and a dishwasher, entering obscure literary competitions advertised on the backs of magazines, while his generation was consumed by Pinochet’s secret prisons and torture cells.

Fittingly, disappearance is perhaps the main action of characters in Bolaño’s works, from the vanished fascist poet and skywriter in 1996’s Distant Star (published in English by New Directions in 2004) to the entire romantic generation of doomed Mexican poets and radicals followed across the span of decades and continents to its vanishing point in a desert of crushed hopes in 1998’s The Savage Detectives (published in English by Farrar, Straus and Giroux in 2007). In 2666, the terminally ill Bolaño wrote as if in an urgent race against the moment of his own departure, unwilling to leave anything out, as if he wanted to save an entire lost underworld from banishment. Taking on every genre from detective noir to the war novel to romantic comedy in an exhilarating, nearly 1,000-page race to the finish, the book is Bolaño’s epic of the disappeared.

The periphery of 2666 teems with Bolaño’s archetypal lost and doomed, a host of minor characters including a former Black Panther leader turned barbecue cook, various Russian writers purged by Stalin during World War II, a Spanish poet living out his days in an asylum, and an acclaimed British painter who cuts off his own hand. There are the usual obscure literary critics and lost novelists, and we even briefly meet an elderly African American man who calls himself "the last Communist in Brooklyn." This last communist could speak for all of Bolaño’s lost and departed when he explains why he presses on: "Someone has to keep the cell alive."

The book’s action, however, centers upon the unsolved serial killings of hundreds of women in the fictional Mexican border city of Santa Teresa during the late 1990s, events based on real-life unsolved killings in Juarez, Mexico. The majority of the women murdered in Juarez were workers at the new factories along the border with the United States, the unregulated maquiladoras that have sprung up in the wake of the North American Free Trade Agreement.

In the book’s longest section, "The Part about the Crimes," we learn the names, one by one, of 111 of these murdered women. In terse, police-blotter language, Bolaño describes the crime scenes — the girls’ clothing, their disappearances, and the police investigators’ attempts to construct the last hours of their lives. Their bodies are discovered slashed, stabbed, bound, gagged, and always raped, in ditches, landfills, alleys, or along the side of the highway. Seen from these vantage points, Bolaño’s Santa Teresa is a disjointed place, seemingly patched together from snatches of barely remembered nightmares. Shantytowns and illegal toxic dumps spring up everywhere in "the shadow of the horizon of the maquiladoras." It is a city that is "endless," "growing by the second," a new type of urban zone in a Latin America that has become a laboratory for free trade policy experiments. It is a city made unmappable by globalization.

Bolaño clearly intends the reader to see the disappearances as the inevitable byproduct of the cheapness of life in the maquiladora economy, yet the killings also eerily evoke the disappearances in fascist 1970s Chile and Argentina. These murders are an open secret, virtually ignored by the media. Residents almost superstitiously refer to them only as "the crimes." The Santa Teresa police respond to the killings with a staggering indifference and ineptitude that might suggest complicity. The maquiladoras are ominous, hulking windowless buildings often in the center of town, not unlike the torture cells once hidden in plain sight in Buenos Aires (Bolaño even names one of them EMSA, an obvious play on Argentina’s most notorious concentration camp, ESMA), and many of the women’s bodies are discovered in an illegal garbage dump called El Chile. 2666 suggests that the unrestrained capitalism of the free-trade era is the ideological descendent of the 1970s South America state repression from which Bolaño fled, and that the killings in Santa Teresa are in part a recreation of the Pinochet-era disappearances.

While the scenes Bolaño describes are grisly, his language is clinical, the cold camera eye of the lone detective gathering evidence. The collective impact of story after story starts to accrue into its own profoundly moral force. By giving name and face to hundreds of disappeared women, Bolaño suggests that literature is a political response, a way to make wrongs right by bearing witness. While it would certainly be a mistake to read 2666 strictly as a political tract, Bolaño explicitly ties writing to justice in a rambling digression about the African slave trade. A Mexican investigator of the killings points out that it was not recorded into history if a slave ship’s human cargo perished on the way to Virginia, but that it would be huge news in colonial America if there was even a single killing in white society: "What happened to (the whites) was legible, you could say. It could be written." For Bolaño, the search for justice is partially about who can be seen in print.

At a literary conference in Seville six months before his death, Bolaño joked that his literary stock might rise posthumously. Sure enough, Bolaño the man has, ironically, vanished after his untimely death, lost in the fog of fame in the English-speaking world. Mainstream critics call his work "labyrinthine" — perhaps English-language critics’ stock adjective for Latin American writers — in a rush to "discover" a new Borges. Bolaño was a high-school dropout who bragged of discovering literature by shoplifting books. He claimed to be a former heroin addict who hung out with the FMLN in El Salvador. His genius deserves comparison to the great Borges, but it’s safe to say that, unlike Borges, a literary lapdog of Argentina’s generals, Bolaño would never have addressed the military leaders of the fascist Argentine coup as "gentlemen." Bolaño wrote without a net, over the abyss of atrocity into which his generation vanished. He did so in an effort to make a literature that recorded for all time where the bodies were buried. As a female reporter in 2666 says, "No one pays attention to these killings, but the secret of the world is hidden in them."

The dangers of believing false narratives should be evident by now. In the wake of our current financial collapse, it is now widely understood that the U.S.’s sense of itself as the richest and most powerful nation in the world has been kept artificially afloat in the recent past by the import of cheap goods and credit from China. These cheap goods are manufactured under labor and environmental conditions much like those of Bolaño’s maquiladoras — conditions we tell ourselves we would never allow here at home, yet which are vital to our economic survival. Dealings with China have, instead, spread repressive tactics in reverse back to corporations from the United States, such as when Google memorably agreed to remove all reference to the 1989 Tiananmen Square massacre from its Google China site.

There is a crucial difference between hope and self-delusion. In its dogged search for uncomfortable truth, 2666 creates a hard-won hope that is different from the way in which that word manifests on the campaign trail. It respects the hope that truth matters, that staring it down can provide the shock of self-awareness that makes real change possible.

In the meantime, there is the hope of literature itself. In 2666, Bolaño devotes a scene to one of his disappeared characters, a Spanish poet who lives out his days in an insane asylum in the countryside. The poet’s doctor — who in a classically deadpan Bolaño twist tells us he is also the poet’s biographer — reflects on the asylum the poet has vanished into. "Someday we will all finally leave (the asylum) and this noble institution will stand abandoned," he says. "But in the meantime, it is my duty to collect information, dates, names. To confirm stories." *

Fisher’s Folly threatens the Presidio

EDITORIAL The latest proposal for developing the Main Post at the Presidio national park shows exactly what’s wrong with the privatized, developer-driven planning that has plagued the 1,400-acre site since Rep. Nancy Pelosi took control of it away from the National Park System.

The centerpiece of the new plan, released last week, is the same old monument to the greed and ego of Gap Inc. founder Don Fisher. The octogenarian billionaire still gets his art museum, a three-building, 200,000-square-foot development that has no place at the Presidio. Oh, it’s not quite as ugly and intrusive the original design: most of the main gallery will be underground, and the roof will be green. How lovely.

The essential problem with the museum remains, and will continue to plague this development plan. The park is making room for a museum, which was never part of anyone’s vision for the new national park when the Army abandoned the post, purely and simply because a billionaire with powerful political connections wants a place to show off his personal art collection. Fisher’s desires are driving the shape of what ought to be a crown jewel of an urban park. The folks who once upon a time thought the Presidio could be a center for sustainable ecology never had a chance.

And a museum of contemporary art is a total mismatch for the Presidio’s main post. A museum is, by its nature, designed to attract large number of visitors — and since there’s only limited transit capacity in the Presidio, most of them will come by car. The center of the park will be overwhelmed with traffic — and so will the surrounding neighborhoods and the streets that serve as the chokepoints for the Presidio’s limited number of entrances and exits. Those cars will compete for space with the growing number of hikers and bicyclists trying to carve out a space in what is, by definition, a park.

The Main Post proposal also includes a large hotel (described as a "lodge," to conjure up images of rustic accommodations) that will feature a high-end restaurant and bar.

This commercialization of the Presidio stands as the legacy of the speaker of the house, who back in 1994 bowed to Republican demands and decided to take the new park away from the people who run every other national park in America and turn it over to a developer-run Presidio Trust. The trust was saddled with a mandate something no other park has ever faced — it has to develop enough real estate to become self-sufficient. And with Fisher as one of the early trust members, the Presidio has become part office park (with a big George Lucas complex that won the moviemaker a $60 million tax break), part shopping center — and now part museum and hotel complex.

This plan — and the overall dreadful direction the park is taking — can still be changed. The seven-member trust board is appointed by the president, and the Obama administration will soon have a chance to fill three of the slots. By tradition the local Congress member (Pelosi) would have a major say in those appointments — but Pelosi is close to Fisher and has set the Presidio on the wrong course. Obama ought to appoint credible environmentalists and preservationists who are wiling to question and oppose Fisher’s grand scheme.

Some well-meaning local museum foes think the best answer is to encourage Fisher to build his personal edifice somewhere else — say, in downtown San Francisco, where other museums are and where there’s adequate transit infrastructure. The Board of Supervisors voted 9-2 to encourage Fisher to follow that path.

We wish he was willing to donate his contemporary art to SFMOMA which is perfectly suited to handle and display it. But Fisher wants total control, and no professional curator would ever accept that. So we’re willing to consider a new Fisher museum downtown. But the city shouldn’t roll out the red carpet for it. If the Republican who made a fortune selling clothes sewn by children in third world sweat shops wants to buy some land and apply for a building permit, the city should treat him like any other developer. But Don Fisher, who has done almost nothing but damage to this city, deserves no special favors.

Street fight

On a drizzly Feb. 17 evening in First Baptist Church, near the intersection of Market and Octavia streets that has become notorious for bicycle versus car collisions, more than 200 members of the San Francisco Bicycle Coalition came together to plot a major offensive.

"We honestly weren’t sure how many people would come out tonight, so this is very impressive," SFBC executive director Leah Shahum told the young, engaged crowd. "We are embarking tonight on the biggest, most ambitious project that the Bike Coalition has ever taken on."

For almost three years, the bicycle advocates have been waiting. Since the city’s bicycle plan was struck down by the courts in 2006 for lack of adequate environmental studies, there’s been a legal injunction against any bike-related projects, leaving an incomplete network of bike lanes even as the number of cyclists in the city soared and SFBC’s membership reached 10,000.

Now, with city officials expecting to have a new plan approved and the injunction lifted by this summer, SFBC has set the ambitious goal of getting all 56 near-term projects mentioned in the plan approved by Bike to Work Day, May 14.

"We’re in a fine position to get the whole enchilada, all 56 projects," Shahum said, a goal that would boost the current 45 miles of bikes lanes to 79 miles and the 23 miles of streets with the "sharrow" bike markings up to 98 miles.

While some knowledgeable sources in the bicycle community say a three-month timeline isn’t realistic for this whole package, the energy and coordination displayed at that meeting shows that this will be a formidable campaign with the potential to rapidly change the streets of San Francisco.

"There’s nothing more to stop this city from going forward with these projects," Andy Thornley told the crowd, sounding more like a military strategist than the SFBC program director that he is. He flipped through slides and stopped at one showing members of the Municipal Transportation Agency Board, which will consider the projects.

"Your mission is to convince these seven people," Thornley told the crowd. "They are the people who say yes to traffic changes or no to traffic changes."

The crowd was divided into nine groups representing different neighborhoods in the city. On the tables at the center of each group were maps, timelines, and other documents, along with sign-up sheets that would be used to organize everyone into online discussion groups to plot strategy and discuss progress and obstacles. Large pieces of butcher paper headlined "Key Stakeholders" and "Issues and Opportunities" were laid out for group brainstorming.

But Thornley made clear that each group would work toward a common goal. "We’ve got to have a whole network," he said. "I don’t want people to lose sight of the fact that the network is the thing."

SFBC community planner Neal Patel defined the expectations: "Every week or every other week, we’ll be asking you to do something."

The groups plan to reach out to supporters and potential opponents in the neighborhoods to make decisions on preferred options within each project, rally the support of political leaders and other influential people, generate media coverage, develop persuasive arguments, and generally create a grassroots political blitzkrieg.

"It’s very easy for the city to say no," Amandeep Jawa, an SFBC board member, told the Mission District group. "The best thing we can do is give them a pile of reasons to say yes."

This wasn’t just the old veterans and familiar faces, but also fresh, young activists like Jennifer Toth, 26, who moved to San Francisco a year ago and has already become invested in this fight.

"The injunction has really held back new biking infrastructure, just at the time when cyclists are increasing exponentially, as people turn to bikes as an alternative to cars. I myself sold my car as soon as I moved here, and really enjoy biking across town," she told the Guardian.

Toth, who has been a part of antiwar and anti-globalization movements, said she was impressed by the SFBC’s approach: "It was really well coordinated, and I love how they made great strides to link neighbors up together."

The next day, at the downtown office of the San Francisco Planning and Urban Research Association, Oliver Gajda, SFMTA’s bike program manager and the point person on the bike plan, led a smaller and more subdued forum on the bike plan.

Gajda noted that the city’s transit-first policy prioritizes safer bicycling over automobiles, which he said is appropriate given that San Francisco is the second most dense city in the country. The most recent SFMTA traffic survey found that 6 percent of all vehicle trips in San Francisco were by bicycle last year, and the number of cyclists increased by 25 percent from the previous year.

The 56 near-term projects identified in the bicycle plan, Gajda said, are designed to quickly make the system safer by improving dangerous sections and addressing the question, "How do we fill those gaps and really complete the bike network?"

He placed the price tag for those first 56 projects at about $20 million, about $4 million of which is covered by existing grants, while longer term projects in the five-year plan would come to about $36 million.

Yet in response to questions from the audience, Gajda admitted that the approval process for some of the more significant near-term projects — such as the bike lanes proposed for Second, Fifth, and 17th streets, which would involve the loss of traffic lanes or parking spaces — could be complicated and controversial.

SFMTA spokesperson Judson True said the agency was still figuring out how to handle the bike projects. "We’re looking at what we can do, how fast, but we share the goals of getting the EIR completed and paint on the street as soon as possible," he said.

True said he welcomes the SFBC campaign. "We’re happy they’re pushing because we want to head in the same direction. We’re definitely stretched, but the commitment to the Bike Plan is enormous at the agency."

That commitment really rankles Rob Anderson, who filed the lawsuit that resulted in the injunction and pledges to oppose SFBC’s campaign. He characterizes bicyclists as a vocal fringe group and said the city shouldn’t take space from Muni or cars to promote bicycling.

"It’s a zero sum game on the streets of San Francisco," Anderson told the Guardian. "They’re going to have to decide how much we want to screw up the streets for this small minority."

While Anderson concedes that the studies now supporting the Bike Plan are "pretty thorough," he notes that many projects will have what the EIR called "significant unavoidable impacts." And he thinks it’s crazy to give over more street space to bicyclists, particularly on crowded corridors like Masonic Avenue.

Anderson’s group, Coalition for Adequate Review (CAR), has never been large — it’s mostly just Anderson and attorney Mary Miles — but he’s likely to find allies among businesses and residents who fear lost parking spaces and other roadway changes as the projects move forward.

"I’m looking forward to this process," Anderson said. "This is crunch time."

There is a subterranean cache of parking spaces in the city that, if justly liberated, could get hundreds of cars off the streets.

I refer to landlords, many of them absentee bridge-and-tunnelers, who are using garage spaces that rightfully should be reserved for tenants’ cars as free storage units for their personal possessions or as permanent parking spots for their own infrequently used cars.

I personally know of two buildings – one a four-unit building in Potrero Hill and the other a 10-unit building in Alamo Square – whose tenants have been forced to vie for street parking for years because their landlords are otherwise occupying the space.

Even more galling, these same landlords have “no parking” signs posted on these garages, and have no qualms about towing or ticketing when their theoretical “driveways” are blocked. (Note to landlords: In typical shit rolling downhill fashion, these displaced tenants often block the bona fide working garages of people who do use their garages to come and go from work, errands, doctor visits and so on. Their justification: “There was no place to park.”)

It’s time for the city to get hip to this cynical practice and eradicate it. Garages should be for the people who live there — in this case, the tenants (who, let’s not forget, are paying some of the highest rents in the country for their apartments). Here are my ideas for accomplishing this.

1. Establish an anonymous tip line for tenants to report landlords who are using their garages in their buildings as storage units. If a landlord is reported, the DPT (or if there is no existing bureaucracy for this, then someone should invent one) should do an inspection. Landlords in violation should be forced to clean out the garages and offer space to their tenants.

2. Landlords who want the space for their personal use – and who have permission from a kindly car-free tenant – should reimburse the tenant at a rate commensurate with long-term parking fees in the city.

3. Landlords whose garages have no cars moving in and out should be prohibited from towing cars blocking the space. Instead, they should allow their tenants to permanently occupy the space, either by parking in the driveway or parallel to the curb in front the driveway (perfectly legal). If multiple tenants want a shot, the landlord should offer a fair rotation.

Incidentally, the DPT does not allow people with non-working garages to issue citations. “No, not allowed. No,” said a DPT dispatcher. “You must be able to demostrate that you can get your car in and out – we will absolutely make you open that garage door to prove it.”

All I’m saying is, let’s add some spirit to the letter of the law.

Lost Angeles

Like some unholy combination of The Man with a Movie Camera (1929) and The Day of the Locust (1975), The Savage Eye (1959) is a kino-essay on American desolation penned by three directors (Joseph Strick, Sidney Meyers, and blacklisted Ben Maddow) and as many cinematographers (Jack Couffer, Helen Levitt, and a young Haskell Wexler). The 65-minute feature’s thin fictional frame story of a spurred Los Angeles woman, Judith X, is no story at all, but rather a vehicle for disembodied anomie. The film is every bit the modernist plaything, complete with a dual voice-over narration, weekend-long time-span, digressive cinematography, spindly Leonard Rosenman score and mechanized portraiture of the metropolis. If The Savage Eye works as a reclamation of the homegrown surrealism borne of street photography and pulp fiction, it’s also no surprise that codirector Strick later filmed adaptations of both Ulysses (1967) and A Portrait of the Artist as a Young Man (1977).

Pinning the nadir of western culture to female consumption is all too typical of the era’s would-be beats, but a sequence like the one in which the male voice-over (pompously listed as "The Poet" in the end credits) asks Judith to read other women’s trivial thoughts is disturbingly cruel. The Savage Eye is diametrically opposed to melodrama, allergic to pathos. It’s difficult to imagine how incendiary it must have seemed in 1960, when Hollywood was just beginning to awake from its long Hays Code slumber. One emblematic shot closely frames a dowdy coupling: he plies her with drinks as she evaluates the bargain being struck out of the corner of her eye. There is an admirable directness to self-contained scenes like this one. With studio noirs, a desultory atmosphere is conveyed peripherally, in a lick of the lips or sweat on the brow; The Savage Eye takes seediness as its subject, like a Weegee book come to life.

The stage may be vulgar, but the players are deathly banal. Judith fantasizes about her ex’s lover’s violent end as she retrieves the mail, a picture of everyday malice worthy of James M. Cain. And yet, no matter how savage this eye means to be, there is a creeping melancholy tugging at the handheld shots of haunted diner cars and half-lit neon. San Francisco Cinematheque screens this dream of a lost city in a fresh restoration print alongside Strick’s earlier document of Los Angeles playing itself, Muscle Beach (1948).

San Francisco has many legacies, including the social movements of the 1960s and ’70s. But before more recent utopian impulses, SF was the Barbary Coast — and Chinatown, North Beach, and the Financial District were havens for gambling, prostitution, and crime. This gritty, nefarious reputation was enhanced in the ’30s by Dashiell Hammett’s novel The Maltese Falcon, and in the ’40s by John Huston’s film version, among other SF-set stories. SF was a noir city, defined by hard drinking and hard living. This is a legacy that the current city perhaps would prefer to forget, much like a blackout during a drunken binge.

In his excellent introduction to the first San Francisco Noir anthology in 2005, editor Peter Maravelis writes, "Crime fiction is the scalpel used to reveal San Francisco’s pathological character." With San Francisco Noir 2: The Classics, Maravelis does more than pick up the scalpel once again. Using a timeline, he reprints some of the grainiest SF snapshots by Barbary Coast writers. He starts with Mark Twain’s hard-boiled description of the infernal Hall of Justice in the late 19th century — a rogues gallery of vermin, where judges drop like flies from stress-induced heart-attacks. He then traces these noir elements to a doppelganger tale by Jack London, on to Hammett, and to contemporary authors such as William T. Vollmann, who writes what Maravelis calls "splatter-noir, where plutocracy has won and the dispossessed give graphic descriptions of the tears in the social fabric." Through recent stories by Janet Dawson, Oscar Penaranda, and others, Maravelis ups the ante, as if to say: this is the real San Francisco. Roger Copeland has his claws out at the very beginning of "Seeing Without Participating," an essay in Warhol Live, the LP-size silver-covered brick of a monograph accompanying an exhibition of the same name devoted to music and dance within Warhol’s gargantuan oeuvre. The target of his attack isn’t as noteworthy as the argument that follows, which is in sync with Peter Gidal’s recent writing on Warhol’s distinct repositioning of traditional forms of participation and spectatorship. From there, Copeland reveals filmmaker and choreographer Yvonne Rainer’s influence on Warhol. Some other musings within Warhol Live spotlight obvious or over-familiar aspects of Pop or rock history. But John Hunisak convincingly argues that Warhol shared Ondine’s love of Maria Callas and recognized her as a punk pioneer; Branden W. Joseph digs up uncommon information about Warhol’s brief stint as a member of a band called the Druds; and Melissa Ragona perceptively taps into Warhol’s (by way of Brigid Berlin’s) recordings.

The book’s vibrant and powerful visual presentation hints that the exhibition — which opens this week at the De Young Museum— might be more rewarding in terms of organization than content. Fluorescent 1980s portraits and Interview covers don’t flatter Warhol, who had fallen into embracing the past-prime Cars and talent-less groups such as Curiosity Killed the Cat by the time of his death. Still, it’s refreshing to see a gathering of sleeve art for his albums, and here and there there’s a surprise pleasure, such as the potent pages devoted to the color slides used at Exploding Plastic Inevitable events. ANDY WARHOL: BLOW JOB

It’s too easy, really, to say that an 86-page appreciation of Andy Warhol’s Blow Job is the critical equivalent of the film’s title. One potentially funny — though also provocative — aspect of Blow Job is its 36-minute length, a span of time that would make any jawbone, even a purely imaginary one, ache. As filmmaker and writer Peter Gidal points out, that time span is partially achieved through projection — like Warhol’s screen tests, Blow Job is presented at the silent-film speed of 18 frames per second, though it was shot at 24 or 25 frames per second.

The temporal is one main focus of Gidal’s heady interpretation of Blow Job, which comes and goes much like the many-reeled subject, and which is art historical and philosophical more often than theoretical, and never vogue-ish when it tends toward the latter. One of the unexpected rewards of this book is Gidal’s discussion of paintings in relation to Warhol’s films, in particular Diego Velázquez’s sinister Luncheon or Three Men at a Table and Marcel Duchamp’s The Bride Stripped Bare by Her Bachelors, Even (The Large Glass). His passage about Warhol’s Shadow series of silkscreens is revelatory. Gidal persuasively removes Warhol from mere camp interpretation, even if his recognition of or devotion to the sensual aspects of Blow Job and Sleep (1963) is fleeting at best. At times, one wishes he could mirror rather than admire and explicate Warhol’s knack for expressing complex ideas in simple, monosyllabic terms. Like Roger Copeland in the new monograph Warhol Live, Gidal is most insightful when addressing the mortal themes and pull of Warhol’s art, and the challenging — and not merely transgressive — manner in which he reframes notions of acting and watching. Tailpipe turnaround

GREEN CITY Word that automobile emissions standards may soon improve was good news, but Bay Area leaders and communities are demanding even more to offset the harm that comes from tailpipes.

President Barack Obama last month called for the U.S. Environmental Protection Agency to allow California and as many as 13 other states to employ their own emissions restrictions. "Our goal," said Obama at the White House, "is not to further burden an already struggling industry. It is to help America’s automakers prepare for the future."

A review of the request is now underway and manufacturers were reassured they would have enough time to rework their 2011 lines. By then, cars and trucks should have improved efficiency and better mileage, outpacing three-year-old national standards that have been in place since the EPA refused to grant a waiver from the federal Clean Air Act.

Locally, the city’s Transportation Authority is reworking the local Climate Action Plan to emphasize emissions reductions. But the problem is expected to get worse before it gets better. Researchers at the Bay Area Air Quality Management District expect greenhouse gas emissions from transportation to increase dramatically from 42.4 million metric tons of carbon dioxide this year to 65.4 million in 2029 under "business as usual conditions."

That may be why Mayor Gavin Newsom and San Jose Mayor Chuck Reed released a letter Jan. 23 opposing federal plans for an auto industry bailout unless there are more strings attached to the money and more progressive programs to develop low-emission vehicles regionally. The two mayors called for an auto bailout that would "not divert funds from innovative emerging transportation technologies."

Jan Lundberg, a former oil industry analyst turned activist and a former member of the San Francisco Peak Oil Preparedness Task Force, calls for even bolder steps: "The kinds of amelioration being talked about and offered are woefully inadequate. We should just get rid of car dependency. Most of the pollution involved — into the air, from the car — is not from the tailpipe. It’s from the mining and the manufacturing associated with the car."

The real challenge for local governments is not in adapting their vehicles, but adapting policy to reflect progressive approaches like San Francisco’s "Precautionary Principle," adopted in 2003. The policy puts the burden of proof on advocates of new technology to show it is safe. Debbie Raphael, the Green Building Program Manager with San Francisco’s Department of the Environment, has been pushing for a change in how environmental codes are implemented. "Taxpayers have every right to know the risks," she said. "The burden then falls on industry to study possible negative consequences and to investigate safer alternatives."

Writer and activist Bill McKibben addressed the issue last fall when he spoke at Herbst Theatre, recognizing San Francisco as an environmental leader among cities. "This is clearly a community that is doing so many of the things right that need to be done. One community at a time is a very noble way to proceed. But in the end, it’s only half the battle. We’ve got to get the political movement going that allows us to do this everywhere, not just in the places that already understand it."

Parking meters in GG Park?

Actually, I’m not against the idea of charging for parking in the parks. Parks are free open space, for use by all, but cars have a clear and negative impact on the park (and I say this as someone who drives my kids there to ride bikes, since they’re not old enough yet to ride on the city streets). Paying a modest fee to put your dangerous, polluting vehicle in the middle of public green space shouldn’t be such a horrible burden.

And I’m all for making commuters who use city parks as parking lots pay.

But I’m not really sure how this would work. Parking meters are the only logical option, but since most people who drive to the park spend a fair amount of time there, the meters have to allow, say, four hours worth of time without requiring users to carry $20 in quarters.

And I wonder: If thieves can dig under the ground and rip up miles of copper wire, what will become of all those nice juicy meters filled with cash, deep in the park late at night?

GREEN CITY San Francisco’s bicycle community found itself in the strange position of encouraging Superior Court Judge Peter Busch — someone many cyclists revile for his strict enforcement of a far-reaching injunction against bike projects in the city — to reject a city-sponsored bike safety proposal during a Jan. 22 hearing. It was one more sign of the desperation bicyclists and city officials are feeling over the three-year-old ban on all things bike-related, from new lanes to simple sidewalk racks (see “Stationary biking,” 5/16/07).

Judge Busch denied a city motion asking for the authority to make safety improvements at intersections that have proven dangerous to bicyclists, as well as a specific proposal by the Municipal Transportation Agency (MTA) to remove the bike lane at the most dangerous of those intersections, on Market Street at Octavia Boulevard, where 15 bicyclists have been hit by cars making illegal right turns onto the freeway since the revamped intersection opened in September 2005.

But the San Francisco Bicycle Coalition and other bicyclists opposed the MTA proposal, arguing it would be more dangerous and holding a Jan. 16 rally at the site, which drew several supportive local politicians, including Sen. Mark Leno, Assembly Member Tom Ammiano, and Sups. Ross Mirkarimi, David Campos, and Bevan Dufty. “As people who ride through that intersection every single day, we believe the proposal would have made the intersection more dangerous. So I’m really relieved that the judge saw that,” SFBC director Leah Shahum told us.

She was less pleased with the judge’s refusal to relax the injunction, which stems from a legal challenge to the San Francisco Bicycle Plan. San Francisco resident Rob Anderson and attorney Mary Miles successfully sued the city in June 2006, arguing that the plan was hasty and did not include an environmental impact report (EIR), as required by state law, to determine how the plan would affect traffic, neighborhoods, businesses, and the environment.

“This case has been very discouraging because there are a handful of activists against bicyclists in the city,” City Attorney’s Office spokesperson Matt Dorsey said. “The hearing showed that the city has to go to court any time it wants to improve the streets for bicyclists.”

Although Judge Busch denied the city’s request to remove the bike lane, he hinted that the injunction would probably be lifted this spring with the completion of the Bike Plan’s EIR. “There was a strong message from the judge that he sees the bigger picture about getting the EIR done. It just needs to be complete and fair and accurate. Then the city can get back to work making the streets safer,” Shahum said.

Both Anderson and the SFBC, who usually agree on little, agreed on the judge’s latest ruling. Anderson advocates maintaining streets for cars and pedestrians, while the SFBC works to make roads safer for bicycles and encouraging bicycling as an important transportation option. Shahum urges city officials to rethink their approach to make Market and Octavia safer. “The city really does need to move on to the next steps to make the intersection better,” she said.

Although the number of bicyclists in San Francisco has doubled in recent years in light of volatile gasoline prices, the economic crisis, and greater awareness of global climate change, Anderson continues to argue that bicyclists will always be a minority interest, even in San Francisco.

“We have to make the streets as safe as possible without strangling the rest of the traffic,” Anderson told the Guardian. “Only a small percentage of the population in San Francisco use bicycles as their main mode of transportation. It’s not fair for the bike people to design the streets just to benefit them.”

Dorsey and Deputy City Attorney Audrey Pearson oppose Anderson, who has said bicycling is an inherently dangerous activity that the city shouldn’t be promoting. “As a policy, the city tries to discourage cars in San Francisco,” Dorsey said, referring to the longstanding “transit first” policies.

Now that the public comment period for the Bike Plan’s Draft EIR is over and Judge Busch has ruled to keep the bike lane at Market and Octavia, all parties are looking ahead to spring when the court is expected to lift the injunction on improving bike safety in San Francisco, unleashing nearly 60 new bike projects. That is, unless Anderson and Miles can find a way to stop them.

Barack Obama is going to have to be a different kind of president, and I don’t mean just policy or the fact that he’s by far the coolest guy to hold that office in my lifetime. I mean he’s going to have to change the tone of how Americans look at our country. He’s going to have to do something that George Bush (and Bill Clinton before him) never did. He’s going to have to get rid of the selfish baby boomer ethos. He’s going to have to talk about sacrifice.

The economy can’t be fixed with deficit spending alone, and the equally massive environmental issues can’t be fixed with just hybrid cars and wind turbines. All those things are important. Without massive federal spending, probably well beyond what Obama is talking about today, the nation will continue to lose millions of jobs, the recession will become a deep depression, and life around here will really suck. And without new technologies, climate change will continue to get worse and energy will become far more expensive and far less reliable.

But in the end, it’s going to take more.

I was listening to the Democratic response to the governor’s State of the State speech Jan. 15 and the KQED radio host asked Darrell Steinberg, the state Senate president pro tem, the basic question of our time: why do Californians want all these wonderful services — education, parks, roads, trains, etc. — but don’t want to pay for them? Steinberg ducked beautifully, but the question still hangs out there. And it’s not just California.

Let us not forget: the United States is still a very wealthy country, and the Bush years made some of its residents exceptionally rich. I just added up the net worth of the top 20 people on the latest Forbes 400 list, and it came to $433 billion. That’s 20 people. The net profits of the top 10 companies on the Fortune 500 list for 2008 totaled more than $100 billion. That’s 10 companies.

Bush never asked any of those people or corporations to help pay for his war. Instead he told them everything would be easy, and gave them juicy tax cuts.

Obama has to set a different tone. He needs to say, loudly and clearly, that those who have the most (far more than they need) in very tough times should be willing to share.

A one-time, 10 percent wealth tax on the ultra-rich would probably raise half a trillion dollars. A short-term excess profits tax (similar to what the nation enacted during World War II) would provide another huge chunk. And it would send a signal to the rest of the country: this isn’t going to be easy. We all have to help out, starting with those at the top.

It also means that, on every level, we all have to get more engaged, more involved in the community. We have to become a nation of givers, not just takers. Public service has to be more important than private profit.

That’s a tough order for a generation raised on selfishness and greed. But it’s the only way out — and the guy we put in office on a banner of change has to lead the way.

Bicyclists sound off

San Francisco bicyclists have become increasingly pissed off about the San Francisco Metropolitan Transportation Agency’s decision last week to try to remove the bike lane at Market and Octavia. They’ve written angry letters, placed irate phone calls, and will tomorrow be holding a rally at the site during the morning commute.
The MTA’s argument that its needs to remove the bike lane in order to save bicyclists from cars making illegal right turns has been pretty much universally rejected by bicyclists, who say it’s akin to the Vietnam War tactic of burning villages in order to save them.
Meanwhile, city officials have definitely felt the sting, and they’ve repeatedly tried to explain the decision to the Guardian and others, so far without being terribly convincing. Will this protest do anything to thwart city plans to seek court approval for the change in a week? We shall see.

Mo Biggie

SONIC REDUCER Wait for it, wait for it: the moment when Jamal Woolard as Notorious B.I.G., a.k.a. Biggie Smalls, a.k.a. Big Poppa, utters, with admirable understatement, "Mo money, mo problems." The woman he married three days after he met her, vocalist Faith Evans (a sad-eyed Antonique Smith), is pregnant but estranged; his spunky protégé Lil’ Kim (Naturi Naughton) is hopping mad that her lover-protector-mentor has dropped her and is instead bossing her in the studio; his original baby mama is miffed that his daughter gets zero Big Poppa time, and his ex-BFF Tupac Shakur (Anthony Mackie) thinks Biggie is out to get him, and the East Coast vs. West Coast beef is now fully fired up. ‘Nuff said.

"Mo Money Mo Problems" is the obvious alternate title for Notorious, which has the ring of a men’s cologne by Sean "I Am King" Combs, aka Puff Daddy, aka P. Diddy, aka Diddy, the film’s executive producer. It’s certainly more glammy — and feeds into the mythmaking that Combs has been so adept at when it comes to his Bad Boy artists — than Unbelievable: The Life, Death, and Afterlife of the Notorious B.I.G. (Three Rivers, 2004), the title of the book by Cheo Hodari Coker that this biopic is based on.

The drive-by shooters who killed the legendary rapper, born Christopher Wallace, at the far-too-young age of 24, remain cloaked in mystery, despite the attention given the MC’s murder in Randall Sullivan’s 2002 book, LAbyrinth (Grove/Atlantic) and Nick Broomfield’s ’02 doc Biggie and Tupac, and his death is still embroiled in knotty intrigue, having triggered multiple wrongful-death claims against the Los Angeles Police Department. But of course, history is written by the winners — and those happen to be Combs and Notorious‘ producers, Biggie’s mother Voletta Wallace and Biggie managers Wayne Barrow and Mark Pitts — and in the end, they prefer to skip the speculation and allegations of conspiracy surrounding the rapper’s unsolved murder and focus on the love.

So much like recent musicmaker biopics à la 2007’s Control, which privileged the perspective of Joy Division frontperson Ian Curtis’ wife over his bandmates’, there’s an element of noticeably selective memory-picking to Notorious — even as it tries to play fair with those outside the equation, such as Shakur and Lil’ Kim. The latter has slammed the movie, according to MTV: she believes it hews to the version of history as written by Biggie’s mother and wife and portrays her inaccurately.

Still, director George Tillman Jr. (Men of Honor, Barbershop) seems to have thrived on the tension between a mother who adored Biggie but disapproved of his criminal activities, and label heads and managers aware that the dope-dealing, dues-paying gangsta grind girding Notorious B.I.G.’s lyrics must be shown to authenticate the first-person experiential honesty the rapper was known for. Thus we get a multidimensional Biggie — the big-kid vulnerability he showed to his moms and his "Faith-Faith," as well as the tough, rock-slinging-to-pregnant-crackheads, money-making front. Plenty of respect is also given to the MC’s art, which this rags-to-riches/gats-to-bitches tale (with much due given to a kind of golden-age of hip-hop label patronage in the form of Puffy [Derek Luke] and Biggie’s friendship) reverently visualizes on the street, in the basement, in the studio, and on the arena stage.

Putting his interest in street-level soul, characters less than well-represented in mainstream Hollywood, and his touch with rappers to work, Tillman subtly injects more cinematic interest into his already-dramatic material than it might have had on the page. Biggie’s childhood is washed with glowy, golden hues, while his time dealing on the street is leached of hues and clad in corroded grays, blacks, whites, and browns, until the MC battles another rapper on the sidewalk and color begins to enter the picture.

And unlike 2008’s Cadillac Records, which bought into the overt displays of bling that talent can bring, Tillman and company give adequate shrift to the musicmaking that built Biggie’s renown: the mic is shot as if it’s a grail, swathed in a silvery aura. The symbols of power — such as the Big Daddy Kane–like throne Biggie mounts — speak louder than his kicks, cribs, or cars. And the scenes in which Woolard actually raps — particularly in a basement scene after he emerges from prison and a bout of lyric writing and soul searching — are believable and compelling: flecks of his spit shimmer in the harsh light. Woolard, who grew up blocks from Biggie’s original hood and had a promising career until a shooting in front of NYC’s Hot 97, is the perfect choice to portray the man.

Notorious‘ melodramatic, overly amped conclusion may ring a bit artificial with its drawn-out return to the opening scenes: as "Hypnotize"’s "Rise" sample ripples through the dancers, Notorious B.I.G. says, in flashback, that he’s finally found peace, he’s become a man, and, well, he’s Ready to Die (Bad Boy, 1994), to crib the title of his classic debut. But I dare anyone to not get choked up by Notorious‘ coda, as Voletta Wallace, portrayed with grand-dame grit by Angela Bassett, looks out on the crowd surrounding her son’s NYC funeral procession, playing his music and flinging their arms, and realizes that, though she never quite trusted the easy money and fast friends surrounding her son, Biggie will always be remembered for his way with words.

We all have high hopes for the new administration. We’d all like to believe that the recession will end soon, that jobs will be plentiful, health care available to all, and affordable housing built in abundance.

But the grim reality is that hard times are probably around for a while longer, and it may get worse before it gets better.

Don’t despair: the city is full of fun things to do on the cheap. There are ways to save money and enjoy life at the same time. If you’re in trouble — out of work, out of food, facing eviction — there are resources around to help you. What follows is a collection of tips, techniques, and ideas for surviving the ongoing depression that’s the last bitter legacy of George W. Bush.

FREE MUSIC AND MOVIES

For a little extra routine effort, I’ve managed to make San Francisco’s library system my Netflix/GreenCine, rotating CD turntable, and bookstore, all rolled into one. And it’s all free.

If you’re a books-music-film whore like me, you find your home maxed out with piles of the stuff … and not enough extra cash to feed your habits. So I’ve decided to only buy my favorites and to borrow the rest. We San Franciscans have quite a library system at our fingertips. You just have to learn how to use it.

Almost everyone thinks of a library as a place for books. And that’s not wrong: you can read the latest fiction and nonfiction bestsellers, and I’ve checked out a slew of great mixology/cocktail recipe books when I want to try new drinks at home. I’ve hit up bios on my favorite musicians, or brought home stacks of travel books before a trip (they usually have the current year’s edition of at least one travel series for a given place, whether it be Fodor’s, Lonely Planet, or Frommer’s).

But there’s much more. For DVDs, I regularly check Rotten Tomatoes’ New Releases page (www.rottentomatoes.com/dvd/new_releases.php) for new DVD releases. Anything I want to see, I keep on a list and search www.sfpl.org for those titles every week. About 90 percent of my list eventually comes to the library, and most within a few weeks of the release date.

And such a range! I recently checked out the Oscar-nominated animated foreign film, Persepolis, the entire first season of Mad Men, tons of documentaries, classics (like a Cyd Charisse musical or Katherine Hepburn and Spencer Tracy’s catalog), even Baby Mama (sure, it sucked, but I can’t resist Tina Fey).

A music fanatic can find virtually every style, and even dig into the history of a genre. I’ve found CDs of jazz and blues greats, including Jelly Roll Morton, John Lee Hooker, Bessie Smith, Muddy Waters, kitschy lounge like Martin Denny and singer Julie London, and have satiated rap cravings with the latest Talib Kwali, Lyrics Born, Missy Elliott, T.I. or Kanye (I won’t tell if you won’t).

Warning: there can be a long "holds" list for popular new releases (e.g., Iron Man just came out and has about 175). When this happens, Just get in the queue — you can request as many as 15 items simultaneously online (you do have a library card, right?) You’ll get an e-mail when your item comes in and you can check the status of your list any time you log in. Keep DVDs a full seven days (three weeks for books and CDs) and return ’em to any branch you like.

I’ve deepened my music knowledge, read a broader range of books, and canceled GreenCine. Instead, I enjoy a steady flow of free shit coming my way each week. And if I get bored or the novelty of Baby Mama wears off, I return it and free up space in my mind (and on my shelf) for more. (Virginia Miller)

STYLE FOR A SONG

Shhh. The first rule about thrifting, to paraphrase mobsters and hardcore thrift-store shoppers, is don’t talk about thrifting — and that means the sites of your finest thrift scores. Diehard thrifters guard their favorite shops with jealous zeal: they know exactly what it’s like to wade through scores of stained T-shirts, dress-for-success suits, and plastic purses and come up with zilcherooni. They also know what it’s like to ascend to thrifter nirvana, an increasingly rarified plane where vintage Chanel party shoes and cool dead-stock Western wear are sold for a song.

Friendships have been trashed and shopping carts upended in the revelation of these much-cherished thrift stores, where the quest for that ’50s lamb’s fur jacket or ’80s acid-washed zipper jeans — whatever floats your low-budg boat — has come to a rapturous conclusion. It’s a war zone, shopping on the cheap, out there — and though word has it that the thrifting is excellent in Vallejo and Fresno, our battle begins at home. When the sample sales, designer runoff outlets, resale dives, and consignment boutiques dry up, here’s where you’ll find just what you weren’t looking for — but love, love, love all the same.

Community Thrift, 623 Valencia, SF. (415) 861-4910, www.communitythrift.bravehost.com. Come for the writer’s own giveaways (you can bequeath the funds raised to any number of local nonprofits), and leave with the rattan couches, deco bureaus, records, books and magazines, and an eccentric assortment of clothing and housewares. I’m still amazed at the array of intriguing junk that zips through this spot, but act fast or you’ll miss snagging that Victorian armoire.

Goodwill As-Is Store, 86 11th St., SF. (415) 575-2197, www.sfgoodwill.org. This is the archetype and endgamer of grab-and-tumble thrifting. We’re talking bins, people — bins of dirt cheap and often downright dirty garb that the massive Goodwill around the corner has designated unsuitable, for whatever reason. Dive into said bins, rolled out by your, ahem, gracious Goodwill hosts throughout the day, along with your competition: professional pickers for vintage shops, grabby vintage people, and ironclad bargain hunters. They may not sell items by the pound anymore — now its $2.25 for a piece of adult clothing, 50 cents to $1 for babies’ and children’s garb, $4 for leather jackets, etc. — but the sense of triumph you’ll feel when you discover a tattered 1930s Atonement-style poison-ivy green gown, or a Dr. Pimp-enstein rabbit-fur patchwork coat, or cheery 1950s tablecloths with negligible stainage, is indescribable.

Goodwill Industries, 3801 Third St., SF. (415) 641-4470, www.sfgoodwill.org Alas, not all Goodwills are created equal: some eke out nothing but stale mom jeans and stretched-out polo shirts. But others, like this Hunter’s Point Goodwill, abound with on-trend goodies. At least until all of you thrift-hungry hordes grab my junk first. Tucked into the corner of a little strip mall, this Goodwill has all those extremely fashionable hipster goods that have been leached from more populated thrift pastures or plucked by your favorite street-savvy designer to "repurpose" as their latest collection: buffalo check shirts, wolf-embellished T-shirts, Gunne Sax fairy-princess gowns, basketball jerseys, and ’80s-era, multicolored zany-print tops that Paper Rad would give their beards for.

Salvation Army, 1500 Valencia, SF. (415) 643-8040, www.salvationarmyusa.org. The OG of Mission District thrifting, this Salv has been the site of many an awesome discovery. Find out when the Army puts out the new goods. The Salvation soldiers may have cordoned off the "vintage" — read: higher priced — items in the store within the store, but there are still plenty of old books, men’s clothing, and at times hep housewares and Formica kitchen tables to be had: I adore the rainbow Mork and Mindy parka vest I scored in the boys’ department, as well as my mid-century-mod mustard-colored rocker.

Savers, 875 Main, Redwood City. (650) 364-5545, www.savers.com When the ladies of Hillsborough, Burlingame, and the surrounding ‘burbs shed their oldest, most elegant offerings, the pickings can’t be beat at this Savers. You’ll find everything from I. Magnin cashmere toppers, vintage Gucci tweed, and high-camp ’80s feather-and-leather sweaters to collectible dishware, antique ribbons, and kitsch-cute Holly Hobbie plaques. Strangest, oddly covetable missed-score: a psychiatrist’s couch.

Thrift Town, 2101 Mission, SF. (415) 861-1132, www.thrifttown.com. When all else fails, fall back on this department store-sized megalith. Back in the day, thrift-oldsters tell me, they’d dig out collectible paintings and ’50s-era bikes. Now you’ll have to grind deeply to land those finds, though they’re here: cute, mismatched, mid-century chairs; the occasional designer handbag; and ’60s knit suits. Hint: venture into less picked-over departments like bedding. (Kimberly Chun)

Low-cost groceries

Maybe you don’t qualify for food assistance programs or you just want to be a little thriftier — in which case the old adage that the early bird gets the metaphorical worm is apropos. When it comes to good food deals, timing can be everything. Here are a couple of handy tips for those of us who like to eat local, organic, and cheap. Go to Rainbow Grocery early and hit the farmers markets late. Rainbow has cheap and half-price bins in the bread and produce sections — but you wouldn’t know it if you’re a late-riser. Get there shortly after doors open at 9 a.m. for the best deals.

By the end of the day, many vendors at farmers markets are looking to unload produce rather than pack it up, so it’s possible to score great deals if you’re wandering around during the last half hour of the market. Then there’s the Grocery Outlet (2001 Fourth St., Berkeley and 2900 Broadway, Oakland, www.groceryoutlets.com), which puts Wal-Mart to shame. This is truly the home of low-cost living. Grocery Outlet began in 1946 in San Francisco when Jim Read purchased surplus government goods and started selling them. Now Grocery Outlets are the West Coast’s version of those dented-can stores that sell discounted food that wasn’t ready for prime-time, or perhaps spent a little too long in the limelight.

Be prepared to eat what you find — options range from name brands with trashed labels to foodstuffs you’ve never seen before — but there are often good deals on local breads and cheeses, and their wine section will deeply expand you Two-Buck Chuck cellar. Don’t be afraid of an occasional corked bottle that you can turn into salad dressing, and be sure to check the dates on anything perishable. The Grocery Outlet Web site (which has the pimpest intro music ever) lists locations and ways to sign up for coupons and download a brochure on how to feed your family for $3 a day. LIVE MUSIC FOR NOTHING — AND KICKS FOR FREE

Music should be free. Everyone who has downloaded music they haven’t been given or paid for obviously believes this, though we haven’t quite made it to that ideal world where all professional musicians are subsidized — and given health care — by the government or other entities. But live, Clive? Where do can you catch fresh, live sounds during a hard-hitting, heavy-hanging economic downturn? Intrepid, impecunious sonic seekers know that with a sharp eye and zero dough, great sounds can be found in the oddest crannies of the city. You just need to know where to look, then lend an ear. Here are a few reliables — occasional BART station busks and impromptu Ocean Beach shows aside.

Some of the best deals — read: free — on world-class performers happen seasonally: in addition to freebie fests like Hardly Strictly Bluegrass every October and the street fairs that accompanying in fair weather, there’s each summer’s Stern Grove Festival. Beat back the Sunset fog with a picnic of bread, cheese, and cheap vino, though you gotta move fast to claim primo viewing turf to eyeball acts like Bettye Lavette, Seun Kuti and Egypt 80, and Allen Toussaint. Look for the 2009 schedule to be posted at www.sterngrove.org May 1.

Another great spot to catch particularly local luminaries is the Yerba Buena Gardens Festival, which runs from May to October. Rupa and the April Fishes, Brass Menazeri, Marcus Shelby Trio, Bayonics, and Omar Sosa’s Afreecanos Quintet all took their turn in the sun during the Thursday lunchtime concerts. Find out who’s slated for ’09 in early spring at www.ybgf.org.

All year around, shopkeeps support sounds further off the beaten path — music fans already know about the free, albeit usually shorter, shows, DJ sets, and acoustic performances at aural emporiums like Amoeba Music (www.amoeba.com) and Aquarius Records (www.aquariusrecords.org). Many a mind has been blown by a free blast of new sonics from MIA or Boris amid the stacks at Amoeba, the big daddy in this field, while Aquarius in-stores define coziness: witness last year’s intimate acoustic hootenanny by Deerhoof’s Satomi and Tenniscoats’ Saya as Oneone. Less regular but still an excellent time if you happen upon one: Adobe Books Backroom Gallery art openings (adobebooksbackroomgallery.blogspot.com), where you can get a nice, low-key dose of the Mission District’s art and music scenes converging. Recent exhibition unveilings have been topped off by performances by the Oh Sees, Boner Ha-chachacha, and the Quails.

Still further afield, check into the free-for-all, quality curatorial efforts at the Rite Spot (www.ritespotcafe.net), where most shows at this dimly lit, atmospheric slice of old-school cabaret bohemia are as free as the breeze and as fun as the collection of napkin art in back: Axton Kincaid, Brandy Shearer, Kitten on the Keys, Toshio Hirano, and Yard Sale have popped up in the past. Also worth a looky-loo are Thee Parkside‘s (www.theeparkside.com) free Twang Sunday and Happy Hour Shows: a rad time to check out bands you’ve never heard of but nonetheless pique your curiosity: Hukaholix, hell’s yeah! And don’t forget: every cover effort sounds better with a pint — all the better to check into the cover bands at Johnny Foley’s (www.johnnyfoleys.com), groove artists at Beckett’s Irish Pub in Berkeley (www.beckettsirishpub.com), and piano man Rod Dibble and his rousing sing-alongs at the Alley in Oakland (510-444-8505). THE CHEAPEST WAY TO GET AROUND TOWN

Our complex world often defies simple solutions. But there is one easy way to save money, get healthy, become more self-sufficient, free up public resources, and reduce your contribution to air pollution and global warming: get around town on a bicycle.

It’s no coincidence that the number of cyclists on San Francisco streets has increased dramatically over the last few years, a period of volatile gasoline prices, heightened awareness of climate change, poor Muni performance, and economic stagnation.

On Bike to Work Day last year, traffic counts during the morning commute tallied more bicycles than cars on Market Street for the first time. Surveys commissioned by the San Francisco Bicycle Coalition show that the number of regular bike commuters has more than doubled in recent years. And that increase came even as a court injunction barred new bike projects in the city (see "Stationary biking," 5/16/07), a ban that likely will be lifted later this year, triggering key improvements in the city’s bicycle network that will greatly improve safety.

Still not convinced? Then do the math.

Drive a car and you’ll probably spend a few hundred dollars every month on insurance, gas, tolls, parking, and fines, and that’s even if you already own your car outright. If you ride the bus, you’ll pay $45 per month for a Fast Pass while government will pay millions more to subsidize the difference. Riding a bike is basically free.

Free? Surely there are costs associated with bicycling, right? Yeah, sure, occasionally. But in a bike-friendly city like San Francisco, there are all kinds of opportunities to keep those costs very low, certainly lower than any other transportation alternative except walking (which is also a fine option for short trips).

There are lots of inexpensive used bicycles out there. I bought three of my four bicycles at the Bike Hut at Pier 40 (www.thebikehut.com) for an average of $100 each and they’ve worked great for several years (my fourth bike, a suspension mountain bike, I also bought used for a few hundred bucks).

Local shops that sell used bikes include Fresh Air Bicycles, (1943 Divisidero, www.fabsf.com) Refried Cycles (3804 17th St., www.refriedcycles,com/bicycles.htm), Karim Cycle (2800 Telegraph., Berkeley, www.teamkarim.com/bikes/used/) and Re-Cycles Bicycles (3120 Sacramento, Berkeley, www.recyclesbicycles.com). Blazing Saddles (1095 Columbus, www.blazingsaddles.com) sells used rental bikes for reasonable prices. Craigslist always has listings for dozens of used bikes of all styles and prices. And these days, you can even buy a new bike for a few hundred bucks. Sure, they’re often made in China with cheap parts, but they’ll work just fine.

Bikes are simple yet effective machines with a limited number of moving parts, so it’s easy to learn to fix them yourself and cut out even the minimal maintenance costs associated with cycling. I spent $100 for two four-hour classes at Freewheel Bike Shop (1920 Hayes and 914 Valencia, www.thefreewheel.com) that taught me everything I need to know about bike maintenance and includes a six-month membership that lets me use its facilities, tools, and the expertise of its mechanics. My bikes are all running smoother than ever on new ball bearings that cost me two bucks per wheel, but they were plenty functional even before.

There are also ways to get bike skills for free. Sports Basement (www.sportsbasement.com) offers free bicycle maintenance classes at both its San Francisco locations the first Tuesday of every month from 6:30-7:30 p.m. Or you can turn to the Internet, where YouTube has a variety of bike repair videos and Web sites such as www.howtofixbikes.com can lead you through repairs.

The nonprofit The Bike Kitchen (1256 Mission, www.thebikekitchen.org) on Mission Street offers great deals to people who spend $40 per year for a membership. Volunteer your time through the Earn-a-Bike program and they’ll give you the frame, parts, and skills to build your own bike for free.

But even in these hard economic times, there is one purchase I wouldn’t skimp on: spend the $30 — $45 for a good U-lock, preferably with a cable for securing the wheels. Then you’re all set, ready to sell your car, ditch the bus, and learn how easy, cheap, fast, efficient, and fun it is to bicycle in this 49-square-mile city. (Steven T. Jones)

LOW-COST HEALTH CARE

When money’s tight, healthcare tends to be one of the first costs we cut. But that can be a bad idea, because skimping on preventive care and treatment for minor issues can lead to much more expensive and serious (and painful) health issues later. Here is our guide to Bay Area institutions, programs, and clinics that serve the under- and uninsured.

One of our favorite places is the Women’s Community Clinic (2166 Hayes, 415-379-7800, www.womenscommunityclinic.org), a women-operated provider open to anyone female, female-identified, or female-bodied transgender. This awesome 10-year-old clinic offers sexual and reproductive health services — from Pap smears and PMS treatment to menopause and infertility support — to any SF, San Mateo, Alameda, or Marin County resident, and all on a generous sliding scale based on income and insurance (or lack thereof). Call for an appointment, or drop in on Friday mornings (but show up at 9:30 a.m. because spots fill up fast).

A broader option (in terms of both gender and service) is Mission Neighborhood Center (main clinic at 240 Shotwell. 415-552-3870, www.mnhc.org, see Web site for specialty clinics). This one-stop health shop provides primary, HIV/AIDS, preventive, podiatry, women’s, children’s, and homeless care to all, though its primary focus is on the Latino/Hispanic Spanish-speaking community. Insurance and patient payment is accepted, including a sliding scale for the uninsured (no one is denied based on inability to pay). This clinic is also a designated Medical Home (or primary care facility) for those involved in the Healthy San Francisco program.

Contrary to popular belief, Healthy San Francisco (www.healthysanfrancisco.org) is not insurance. Rather, it’s a network of hospitals and clinics that provide free or nearly free healthcare to uninsured SF residents who earn at or below 300 percent of the federal poverty level (which, at about $2,600 per month, includes many of us). Participants choose a Medical Home, which serves as a first point-of-contact. The good news? HSF is blind to immigration status, employment status, and preexisting medical conditions. The catch? The program’s so new and there are so many eligible residents that the application process is backlogged — you may have a long wait before you reap the rewards. Plus, HSF only applies within San Francisco.

Some might consider mental health less important than that of the corporeal body, but anyone who’s suffered from depression, addiction, or PTSD knows otherwise. Problem is, psychotherapy tends to be expensive — and therefore considered superfluous. Not so at Golden Gate Integral Counseling Center (507 Polk. 415-561-0230, www.goldengatecounseling.org), where individuals, couples, families, and groups can get long- and short-term counseling for issues from stress and relationships to gender identity, all billed on a sliding scale.

Other good options

American College of Traditional Chinese Medicine (450 Connecticut, 415-282-9603, actcm.edu). This well-regarded school provides a range of treatments, including acupuncture, cupping, tui ma/shiatsu massage, and herbal therapy, at its on-site clinics — all priced according to a sliding scale and with discounts for students and seniors. The college also sends interns to specialty clinics around the Bay, including the Women’s Community Clinic, Haight Ashbury Free Medical Clinic, and St. James Infirmary.

Though geared towards Native Americans, this multifaceted clinic (dental! an Oakland locale, and an Alameda satellite!) turns no one away. Services are offered to the under-insured on a sliding scale as well as to those with insurance.

SF Free Clinic (4900 California, 415-750-9894, www.sffc.org). Those without any health insurance can get vaccinations, diabetes care, family planning assistance, STD diagnosis and treatment, well child care, and monitoring of acute and chronic medical problems.

Haight Ashbury Free Clinics (558 Clayton. 415-746-1950, www.hafci.org): Though available to all, these clinics are geared towards the uninsured, underinsured "working poor," the homeless, youth, and those with substance abuse and/or mental health issues. We love this organization not only for its day-to-day service, but for its low-income residential substance abuse recovery programs and its creation of RockMed, which provides free medical care at concerts and events. THE BEST HOMELESS SHELTERS

There’s no reason to be ashamed to stay in the city’s homeless shelters — but proceed with awareness. Although most shelters take safety precautions and men and women sleep in separate areas, they’re high-traffic places that house a true cross-section of the city’s population.

The city shelters won’t take you if you just show up — you have to make a reservation. In any case, a reservation center should be your first stop anyway because they’ll likely have other services available for you. If you’re a first-timer, they’ll want to enter you into the system and take your photograph. (You can turn down the photo-op.) Reservations can be made for up to seven days, after which you’ll need to connect with a case manager to reserve a more permanent 30- or 60-day bed.

The best time to show up is first thing in the morning when beds are opening up, or late at night when beds have opened up because of no-show reservations. First thing in the morning means break of dawn — people often start lining up between 4 a.m. and 6 a.m. for the few open beds. Many people are turned away throughout the day, although your chances are better if you’re a woman.

You can reserve a bed at one of several reservation stations: 150 Otis, Mission Neighborhood Resource Center (165 Capp St.), Tenderloin Resource Center (187 Golden Gate), Glide (330 Ellis), United Council (2111 Jennings), and the shelters at MSC South (525 Fifth St.) and Hospitality House (146 Leavenworth). If it’s late at night, they may have a van available to give you a ride to the shelter. Otherwise, bus tokens are sometimes available if you ask for one — especially if you’re staying at Providence shelter in the Bayview-Hunters Point District.

They’ll ask if you have a shelter preference — they’re all a little different and come with good and bad recommendations depending on whom you talk to. By all accounts, Hospitality House is one of the best — it’s small, clean, and well run. But it’s for men only, as are the Dolores Street Community Services shelters (1050 S. Van Ness and 1200 Florida), which primarily cater to Spanish-speaking clients.

Women can try Oshun (211 13th St.) and A Woman’s Place (1049 Howard) if they want a men-free space. If kids are in tow, Compass Family Services will set you up with shelter and put you on a waiting list for housing. (A recent crush of families means a waiting list for shelters also exists.) People between 18 and 24 can go to Lark Inn (869 Ellis). The Asian Woman’s Shelter specializes in services for Asian-speaking women and domestic violence victims (call the crisis line 877-751-0880). IMPRESS A DATE WITH DINNER UNDER $50

You’ve got a date this weekend, which you’re feeling pretty good about, but only $50 to spend, which feels … not so good. Where should you go?

You’ll appear in-the-know at the underrated Sheba Piano Lounge (1419 Fillmore, www.shebalounge.com) on lower Fillmore Street, right in the middle of the burgeoning jazz revival district. Sheba was around long before Yoshi’s, offering live jazz (usually piano, sometimes a vocalist) and some of the best Ethiopian food in the city in a refined, relaxed lounge setting. Sure, they’ve got Americanized dishes, but skip those for the traditional Ethiopian menu. Sample multiple items by ordering the vegetarian platter ($13) or ask for a mixed meat platter, which is not on the menu ($16 last time I ordered it). One platter is more than enough for two, and you can still afford a couple of cocktails, glasses of wine or beer, or even some Ethiopian honey wine (all well under $10). Like any authentic Ethiopian place I’ve eaten in, the staff operates on Africa time, so be prepared to linger and relax.

It’s a little hipster-ish with slick light fixtures, a narrow dining room/bar, and the increasingly common "communal table" up front, but the Mission District’s Bar Bambino (2931 16th St., www.barbambino.com) offers an Italian enoteca experience that says "I’ve got some sophistication, but I like to keep it casual." Reserve ahead for tables because there aren’t many, or come early and sit at the bar or in the enclosed back patio and enjoy an impressive selection of Italian wines by the glass ($8–$12.50). For added savings with a touch of glam, don’t forget their free sparkling water on tap. It’s another small plates/antipasti-style menu, so share a pasta ($10.50–$15.50), panini ($11.50–$12.50), and some of their great house-cured salumi or artisan cheese. Bar Bambino was just named one of the best wine bars in the country by Bon Apetit, but don’t let that deter you from one of the city’s real gems.

Nothing says romance (of the first date kind) like a classic French bistro, especially one with a charming (heated) back patio. Bistro Aix (3340 Steiner, www.bistroaix.com) is one of those rare places in the Marina District where you can skip the pretension and go for old school French comfort food (think duck confit, top sirloin steak and frites, and a goat cheese salad — although the menu does stray a little outside the French zone with some pasta and "cracker crust pizza." Bistro Aix has been around for years, offering one of the cheapest (and latest — most end by 6 or 7 p.m.) French prix fixe menus in town (Sunday through Thursday, 6–8 p.m.) at $18 for two courses. This pushes it to $40 for two, but still makes it possible to add a glass of wine, which is reasonably priced on the lower end of their Euro-focused wine list ($6.25–$15 a glass).

FREE YOGA

You may be broke, but you can still stay limber. San Francisco is home to scores of studios and karmically-blessed souls looking to do a good turn by making yoga affordable for everyone.

One of the more prolific teachers and donation-based yoga enthusiasts is Tony Eason, who trained in the Iyengar tradition. His classes, as well as links to other donation-based teachers, can be found at ynottony.com. Another great teacher in the Anusara tradition is Skeeter Barker, who teaches classes for all levels Mondays and Wednesdays from 7:45 to 9:15 p.m. at Yoga Kula, 3030a 16th St. (recommended $8–$10 donation).

Sports Basement also hosts free classes every Sunday at three stores: Bryant Street from 1 to 2 p.m., the Presidio from 11a.m. to noon, and Walnut Creek 11 a.m. to noon. Bring your own mat.

HOW TO KEEP YOUR APARTMENT

So the building you live in was foreclosed. Or you missed a few rent payments. Suddenly there’s a three-day eviction notice in your mailbox. What now?

Don’t panic. That’s the advice from Ted Gullicksen, executive director of the San Francisco Tenants Union. Tenants have rights, and evictions can take a long time. And while you may have to deal with some complications and legal issues, you don’t need to pack your bags yet.

Instead, pick up the phone and call the Tenants Union (282-6622, www.sftu.org) or get some professional advice from a lawyer.

The three-day notice doesn’t mean you have to be out in three days. "But it does mean you will have to respond to and communicate with the landlord/lady within that time," Gullicksen told us.

It’s also important to keep paying your rent, Gullicksen warned, unless you can’t pay the full amount and have little hope of doing so any time soon.

"Nonpayment of rent is the easiest way for a landlord to evict a tenant," Gullicksen explained. "Don’t make life easier for the landlady who was perhaps trying to use the fact that your relatives have been staying with you for a month as grounds to evict you so she can convert your apartment into a pricey condominium."

There are, however, caveats to Gullicksen’s "always pay the rent" rule: if you don’t have the money or you don’t have all the money.

"Say you owe $1,000 but only have $750 when you get the eviction notice," Gullicksen explained. "In that case, you may want to not pay your landlord $750, in case he sits on it but still continues on with the eviction. Instead, you might want to put the money to finding another place or hiring an attorney."

A good lawyer can often delay an eviction — even if it’s over nonpayment or rent — and give you time to work out a deal. Many landlords, when faced with the prospect of a long legal fight, will come to the table. Gullicksen noted that the vast majority of eviction cases end in a settlement. "We encourage all tenants to fight evictions," he said. The Tenants Union can refer you to qualified tenant lawyers.

These days some tenants who live in buildings that have been foreclosed on are getting eviction notices. But in San Francisco, city officials are quick to point out, foreclosure is not a legal ground for eviction.

Another useful tip: if your landlord is cutting back on the services you get — whether it’s a loss of laundry facilities, parking, or storage space, or the owner has failed to do repairs or is preventing you from preventing you from "the quiet enjoyment of your apartment" — you may be able to get a rent reduction. With the passage of Proposition M in November 2008 tenants who have been subjected to harassment by their landlords are also eligible for rent reductions. That involves a petition to the San Francisco Rent Stabilization and Arbitration Board (www.sfgov.org/site/rentboard_index.asp).

Gullicksen also recommends that people who have lost their jobs check out the Eviction Defense Collaborative (www.evictiondefense.org).

"They are mostly limited to helping people who have temporary shortfalls," Gullicksen cautioned. But if you’ve lost your job and are about to start a new one and are a month short, they can help. (Sarah Phelan)

OUT OF WORK? HERE’S STEP ONE

How do you get your unemployment check?

"Just apply for it."

That’s the advice of California’s Employment Development Department spokesperson Patrick Joyce.

You may think you aren’t eligible because you may have been fired or were only working part-time, but it’s still worth a try. "Sometimes people are ineligible, but sometimes they’re not," Joyce said, explaining that a lot of factors come into play, including your work history and how much you were making during the year before you became unemployed.

"So, simply apply for it — if you don’t qualify we’ll tell you," he said. "And if you think you are eligible and we don’t, you can appeal to the Unemployment Insurance Appeals Board."

Don’t wait, either. "No one gets unemployment benefits insurance payments for the first week they are unemployed," Joyce explained, referring to the one-week waiting period the EDD imposes before qualified applicants can start collecting. "So you should apply immediately."

Folks can apply by filling out the unemployment insurance benefits form online or over the phone. But the phone number is frequently busy, so online is the best bet.

MTA tries to help cyclists by removing bike lanes

San Francisco’s bicycle community is baffled by last night’s unanimous Metropolitan Transportation Agency vote to seek the removal of bike lanes at the intersection of Market and Octavia, where more than a dozen cyclists have been injured by cars making illegal right turns onto the freeway.
The logic offered by MTA traffic engineer Jack Fleck and the City Attorney’s Office (which is apparently concerned about liability issues after a couple injured cyclists sued the city) is that forcing bikes and cars to merge into one lane will prevent drivers from inadvertently turning into cyclists.
But that logic apparently only makes sense to bureaucrats and lawyers (and Mayor Gavin Newsom’s MTA appointees, none of whom seem to understand bike issues) because the plan has been uniformly criticized today by cyclists and other alternative transportation types. They say the forced merge at that busy intersection will only create more conflicts between bikes and cars.
“It makes no sense. I was really surprised they even brought it to the board,” said Leah Shahum, executive director of the San Francisco Bicycle Coalition, which was not consulted on the proposal.
Even the Planning Department agrees this is a dumb idea, one that conflicts with the Upper Market Design Plan that was approved less than two months ago. It calls for raised, colored bike lanes to make cyclists more visible and with trees and other visual barriers to make that illegal turn less attractive to drivers.
Ironically, bicyclists are placing their hopes for killing the proposal in Judge Peter Busch, who issued the current injunction against new bicycle projects and who will be asked Jan. 22 to approve this proposal. As Shahum said, “Our hope is that the judge denies it.”

SONIC REDUCER Wow, 80 years old and such a beauty: I took a peek at Oakland’s Fox Theatre — yes, a distant relation to San Francisco’s late, lamented Fox — before the holiday break and, whoa, wolf whistles. The friendly rival to the Paramount around the corner is definitely beginning to feel like her glam self once more, decked out in a fabulist fantasia of Indian-Moorish finery, and in December, positively glowing beneath the hands of the workers intent on restoring her to her rightful splendor — and upgrading her in key spots with new bathrooms, dressing rooms, balcony seats, and a new Meyer sound system.

The now-2,800-capacity live-music venue operated as a movie house from 1928 until it closed in 1965. Placed on the National Register of Historic Places in 1979, the Fox was purchased by the city of Oakland in 1996 — after undergoing the threat of being turned into a parking lot and the indignity of arson, water damage, and neglect — and is now under the aegis of developer Phil Tagami and Another Planet Entertainment, readying to reopen Feb. 5. Its first show is on Feb. 6 with Social Distortion.

According to Another Planet VP Allen Scott, "We have been working on this project for close to four years and there has been a lot of blood, sweat … and now cheers." The Fox will be APE’s flagship venue — showcasing everything from rock to soul to Latin.

Great expectations, yet from the mere look of it, the Fox’s prospects are as marvelous as its beauteous shell. It’s safe for me to say — after walking by the magnificently lit-up neon marquee, tiled towers, and faux-sikhara for years and wondering what was inside — the Fox will not disappoint anyone who wants an eyeful of glorious, orientalist movie-palace exotica. Two Hindu gods look down on shining new floors from the sides of the gold-hued stage, styled to resemble the temples of Palitana, below a highly ornate star-splashed ceiling. The mezzanine: a magic-carpet ride of tiled niches and stenciling patterned after Persian carpets. The venue itself will be topped by Oakland School of the Arts and be flanked by a restaurant and bar that will keep the corner lively when shows aren’t scheduled.

It’s a miraculous save — long coming — for Fox followers like Patricia Dedekian, founding board member of Friends of the Oakland Fox. "Every time I go in there now I start crying because it’s so exciting and emotional," Dedekian said. She hopes to raise money for an endowment for the Fox’s continued preservation and upkeep.

"I used to describe the Fox Oakland as the black hole that sits in center of Uptown," she continued. "It was clear this was a big project waiting to happen. Now I can believe it when I see it."

ZAP! After a horrible fall on Landers Street during a drunken stumble home on the rainy eve of Nov. 1, San Francisco underground artist S. Clay Wilson, 67, is drawing again, reports his partner Lorraine Chamberlain.

Chamberlain is still trying to track down the Good Samaritan — or guardian checkered demon — who found Wilson with a fracture and gash in his head lying between two parked cars, made the 911 call, and waited with the artist till the ambulance arrived — an act that saved the cartoonist from perishing from hypothermia. "He was like a block of ice," Chamberlain told me. "If he had been there a couple more hours they would never have been able to stabilize him." But right now she’s glad that after spending his first two weeks in a semi-coma with a bout of pneumonia, Wilson is attacking his colored pencils and vellum with gusto, making drawings that don’t quite resemble the super-maximalist, sensory-overload, iconoclastic pieces of Zap Comix, though Chamberlain added, "they’re quite good."

Word has it the cartoonist is cracking wise in his room at Davies Medical Center, though he still suffers from aphasia and impaired short-term memory. "He called me in the morning and said he was doing a drawing of hobbling zombies — he said it three times. He meant, rotting zombies," explained Chamberlain, an ex of Frank Zappa’s who coined his nickname, Lumpy Gravy. "He talks on and on about things that aren’t based in reality, and I realized he was doing a verbal drawing, just talking a drawing rather than doing it."

The Christmas artwork he gave her was "pretty hideous. A couple of ugly guys, one guy in a gray suit and a little guy standing there with a muffin tin of steaming piles of shit, and a big ugly guy with a shovel with holes in it and it says, ‘Merry Ex Mass.’"

Wilson is on Medicare, Chamberlain said, but needs continuing care. Thus checks are being sent to S. Clay Wilson, POB 14854, San Francisco, CA 94114, from all over the country — the Jan. 11 fundraiser comes courtesy of his friends in Brutal Sound Effects (a blues benefit happens Jan. 24 at Mojo Lounge, Fremont). Meanwhile Chamberlain can’t wait for Wilson to come home. "I miss him," she said. "He’s a pain in the ass, he’s hard to live with, but I got used to it!"

Lethal force

The autumn air was crisp and clear in Hayward on the night the kid called Glasstop took a shotgun blast in the back of the head and died for the theft of a $60 radio.

It was just before 8 p.m., on Sunday, Nov. 15. The lights were on in the parking lot outside the Hayward BART station, where a six-car southbound train had arrived a few minutes earlier. About 50 passengers had gotten off, and some were still straggling into cars or waiting around for the next AC Transit bus.

Glasstop, a 19-year-old warehouse worker from Union City whose legal name was Jerrold Cornelius Hall, had ridden the train from Bayfair, one stop north, along with John Henry Owens, a 20-year-old unemployed custodian who lived in Oakland. The two young African American men were standing at the bus stop, not far from the station entrance, when Officer Fred Crabtree pulled into the parking lot in a BART police cruiser.

Crabtree was a white 16-year veteran of the transit police agency and a member of its elite Canine Corps. His partner was a highly trained German shepherd imported from a special obedience school in Germany. The dog trotted at Crabtree’s side as he approached Owens and Hall. The officer carried a loaded 12-gauge pump-action shotgun.

Crabtree was responding to a report of an armed robbery: Halfway between Bayfair and Hayward, a passenger had told the train operator that two black men had taken his Walkman personal stereo. The passenger said one of the robbers had a gun and described what they looked like; the trainman passed on the message, and the BART dispatcher passed it on again. Owens and Hall matched the third-hand description that came over Crabtree’s radio.

Within a matter of minutes, Hall was lying in a pool of his own blood, Owens was in handcuffs, and the parking lot was a mass of sirens and flashing red lights. Hall was pronounced dead shortly after midnight at Eden Hospital; Owens is still in the Alameda County jail. The police never turned up a gun.

And the man who reported the robbery disappeared without leaving his name.

That’s about all BART officials will say about the incident. They’ve clamped on a lid of secrecy that defies most normal local police procedures and violates the California Public Records Act. The San Francisco newspapers have almost entirely ignored the shooting, and there’s been little reaction from the East Bay community.

But an extensive Bay Guardian investigation has turned up a long list of troubling questions about the death of Jerrold Hall – and a long list of serious problems in an agency that has some of the most sweeping police powers in California, and some of the least civilian oversight.

Our investigation, based on a dozen interviews, a review of public records, and more than 50 pages of unreleased internal documents from the BART police and other local authorities, shows:

Officer Crabtree violated one of the most basic rules of modern law enforcement – and his own department’s written policy – when he fired a warning shot toward the suspect, potentially endangering the lives of passersby in the busy urban area. The nine .33-caliber pellets from that shotgun cartridge wound up in the side of a tree, about 4-1/2 feet above the ground.

BART’s own internal documents contradict the official claim that Hall was attacking or threatening Crabtree at the time of the shooting. Statements filed by several witnesses, and at least two BART police officers, suggest that Hall was more than 10 feet from the officer when the shots were fired, and was walking away. Medical records obtained by the Bay Guardian show that he was shot in the back of the head.

The shooting appears to violate nearly every modern police standard on the use of deadly force. In fact, the latest BART Police Operational Directive, dated July 22, 1987, states that guns may be fired only to prevent a suspect from killing or wounding another person, or to stop a suspected felon who is presumed to be armed and dangerous from fleeing and escaping arrest. But BART internal documents and other records obtained by the Bay Guardian provide little evidence to suggest that Hall fit either category.

Nevertheless, on Dec. 4, a BART Firearms Review Board, consisting entirely of BART police officers appointed by the chief, determined that the “use of lethal force in this instance was justified.” BART officials refuse to release the report or comment further on the findings.

The fact that Crabtree fired a gun to subdue Hall seems to undermine one of BART’s central reasons for the use of trained attack dogs. The dogs, BART officials say, are supposed to support officers in situations just like the one in question – to intimidate, and if necessary, pursue and immobilize a suspect when other backup isn’t available, and to attack immediately if an officer is under assault. Some law-enforcement experts, and many civil-rights advocates, question the use of dogs for that purpose – but all those contacted by the Bay Guardian agreed it was rather curious that Crabtree’s canine partner sat out this whole bloody incident.

Officer Crabtree is on administrative leave, with pay, pending the final outcome of an internal investigation. Owens is still facing robbery charges, despite the lack of a victim willing to testify against him. A preliminary hearing is scheduled for this week.

But the problems with the BART police go far beyond the arrest of John Owens and the death of Jerrold Hall. In fact, the Bay Guardian has learned:

BART’s Internal Affairs Division, which reviews citizen complaints against BART police officers, has investigated 162 cases in the past five years, 39 of them involving excessive use of force – and not a single charge was sustained. Law-enforcement observers say that’s an astonishing statistic, one that casts severe doubt on the department’s ability to control police abuse.

“I’ve never heard of any department with a rate of zero sustained complaints,” said John Crew, director of the American Civil Liberties Union Police Practices Project. “I can’t believe that none of those people had a single valid case.”

The BART Police Department has a written procedure for civilians filing complaints. A 1991 directive signed by Chief Harold Taylor states that every department employee should accept complaints by mail, by phone, or in person, and refer them to the watch commander or the Internal Affairs Division. But there’s nothing posted in any BART train or station to tell the public about the complaint process, no procedure for appealing a Police Department decision to a civilian review agency, and not much visible effort to inform BART employees about how to handle complaints.

The BART police use dogs for purposes inconsistent with many modern law-enforcement guidelines. Most local police agencies employ canines primarily to sniff out bombs and narcotics, or to search for dangerous suspects hidden in dark, confined areas. Berkeley has banned police dogs altogether. The BART police dogs are not trained to sniff out bombs or drugs, and are rarely involved in searches; the officers use the animals as standard backup, to intimidate and apprehend suspects in even fairly routine arrests.

The elected BART Board of Directors has demonstrated virtually no effective control over the BART police, and most board members don’t seem to know or care what their armed employees are doing with those badges, dogs, and guns.

None of the board members contacted by the Bay Guardian could even guess how many citizen complaints had been filed against the BART police since 1988, or what the outcome of the cases had been. None could explain the complaint procedure, or identify the person responsible for supervising internal investigations. Most didn’t know how the police chief was hired, or to whom he reported; some board members didn’t even know his name.

Several years ago, I asked Art Shartsis, a downtown lawyer who was then the BART Board president, if he knew who ran the BART police. His answer was unusually blunt, but entirely typical of the attitude board members show toward the force.

“I don’t know,” he told me. “I guess we must have a chief.”

A DAY AT THE MALL

Jerrold Hall was the son of Alameda Fire Department Captain Cornelius Hall, a retired Navy Reserve officer who lives with his wife, Rose and two other sons in a comfortable middle-class home in suburban Union City. Both of Jerrold’s brothers are in college, earning top grades; his aunt is the first black woman ever to serve on the Board of Trustees of Auburn University.

Jerrold, who graduated from high school in 1991 and was living with his parents, “had some problems, like a lot of kids these days,” his father told me. “But we hoped he’d outgrow them. He was a good kid, never into guns or killing or any of that sort of thing.”

On Sunday, Nov. 15, at about 2 in the afternoon, Hall met Owens at the Eastmont Mall in Oakland. According to a sworn statement Owens gave to the police, the two drank a few beers and part of a small bottle of E&J Brandy. Early in the evening, Hill invited Owens to his home, and they left the mall on an AC Transit bus to catch a BART train for Union City.

According to Owens and several other witnesses, Owens and Hill encountered a black man in his late 30s on board the train, and the man asked them if they wanted to buy one of the Walkmans he was carrying in a bag. When first questioned by police, at about 1:35 a.m., Owens said he declined the offer, went to another train car “where more girls were,” and met up with Hall again a few minutes later. At about 4:30 a.m., he made another statement, acknowledging that he was present when the friend he called “Glasstop” told the would-be salesman, “give me your Walkman.”

Several other witnesses on the train agreed that Hall had confronted the man, and walked away with a bag. None, including Owens, saw a gun.

However, the victim of what the BART police still call an “armed robbery” called the train operator on the intercom and said two men with a gun had stolen his Walkman. The operator, who never saw Hall or Owens, reported the incident, and it was relayed to BART police, who instructed the trainman to stop in Hayward, and, after a brief delay, to open the train doors. Hall and Owens left with about 50 others; according to the station attendant, they jumped the emergency gate and walked into the parking lot.

The police were able to find several eyewitnesses to the alleged robbery; however, other than Owens and Crabtree, who was the only police officer on the scene at the time, the internal report does not identify a single witness who actually saw the shooting.

An official Dec. 7 statement, written by BART Police Chief Harold Taylor at the request of the Bay Guardian and reviewed by BART’s legal department, notes that “witnesses disagreed as to the precise sequence of the next events.”

The internal BART police documents obtained by the Bay Guardian contain no formal statement or direct quotation from Crabtree; he apparently filed no written report. The reports were all prepared by other officers, who arrived at the scene after the shooting.

According to those reports, filed shortly after the incident, Crabtree approached Hall and Owens, who were standing near a bench in the parking lot’s bus-stop area, and ordered them to lie on the ground with their hands over their heads. Owens complied; Hall did not.

Hall, the reports state, “confronted and challenged Officer Crabtree, attempting to take Officer Crabtree’s shotgun from him at one point.” There is no mention of what the dog, who was trained to bite anyone who attacked Officer Crabtree, was doing at the time. BART officials refuse to elaborate, saying the incident is still under investigation.

However, one Bay Area dog trainer, who has trained police dogs, said it’s highly unlikely that a German shepherd of the sort imported by the BART police (see sidebar) would fail to respond in such a situation. “Dogs are very loyal and protective,” the trainer, who asked not to be identified, told the Bay Guardian. “These dogs are carefully bred and taught to attack anyone who physically endangers their human handler. Sometimes they overreact; they very rarely underreact.”

TO TAKE A LIFE

Owens told the police he “did not see the cop and Glasstop get into any physical fighting. They did not touch. They were just arguing.” After a few moments, Owens said, “Glasstop walked over to me and said we could go. So we started to walk away.”

Whatever the nature of the confrontation between Hall and Officer Crabtree, the police report and witness statements leave very little doubt that it ended with Hall walking away – and, as the internal police report states, “with Officer Crabtree retaining the shotgun.”

It’s also clear that some time, perhaps as much a minute or two, passed between the initial clash and the shooting – more than enough time for Hall and Owens to start walking away. During that period, the documents suggest, the passenger who had initially reported the robbery – and had not made any contact yet with police – suddenly ran out into the parking lot, pointed toward Hall and Owens and shouted, “That’s them.” Then the passenger fled.

Crabtree then ordered the two young men to halt again – and at that point, the statements get very fuzzy.

According to the official statement released Dec. 7 by BART, Crabtree “summoned his canine, but Hall resisted the dog.” A medical report filed by Alameda County emergency technicians who examined Hall after the shooting includes no mention of any dog bites or wounds of any sort other than those caused by the shotgun. A copy of the report, which has not been released, was obtained by the Bay Guardian.

Crabtree, the official BART statement continues, “fired a warning shot at a nearby tree. Hall continued to move toward the other suspect, and at one point turned and assumed a position which concealed his hands.”

The internal police report, however, states that Owens was the one who was “failing to keep his hands in view,” and who, in what the report described as “an effort to get rid of the evidence [Walkman],” put his hands into his pants pockets. At that point, the report states, Crabtree “used deadly force on suspect Hall.”

Owens said he responded immediately to the second command to halt, but that Hall kept walking away. When Owens heard the shots, he turned around, “and my partner was lying face down…. Then I heard all the cops coming with sirens.”

In fact, within a matter of minutes, at least three more BART police cars and a backup unit from the Hayward Police Department had arrived on the scene. Even if Hall, who by all accounts was walking, not running, had been attempting to “flee,” it’s unlikely he would have been able to get far.

And after an extensive search of the train, the tracks, the station, the parking lot, and everything else in the vicinity, the BART police acknowledge they were unable to find a gun.

Although the BART police initially insisted that Hall had been shot in the chest, and most of the news reports carried that statement unchallenged, even BART now admits that the shot struck the young man in the back of his head. His father, Cornelius Hall, never had any doubt.

“I’m a trained emergency medical technician,” he told the Bay Guardian. “I was in the hospital room when the nurse was washing down the body. I know what an entrance wound looks like, and my son was shot in the back.”

In Modern Police Firearms, a textbook on law-enforcement procedures, Professor Allen P. Bristow of California State University, Los Angeles, writes that deadly force should be used to stop a fleeing felon only when “he cannot be contained or captured” through other means. Further, Bristow notes, an officer considering deadly force should ask the following question:

“Is the crime this suspect is committing, or are the consequences of his possible escape, serious enough to justify my taking his life or endangering the lives of bystanders?”

The San Francisco Police Department guidelines on deadly force embody some of that same philosophy. “Officers shall exhaust all other reasonable means of apprehension and control before resorting to the use of firearms,” the Aug. 24, 1984, policy states. Officers are allowed to shoot at a dangerous, fleeing felony suspect “only after all other reasonable means of apprehension and control have been exhausted.”

San Francisco, like almost every other police agency in the Bay Area, and most in the country, strictly prohibits warning shots. So does BART: “Discharging of firearms [is] not allowable as a warning,” BART’s official weapons policy states.

The BART police are a bit more lenient than San Francisco on the use of deadly force to stop fleeing suspects. The officer must only believe that “the suspect is likely to continue to threaten death or serious bodily harm to another human being,” according to BART’s July 22, 1987, operational directive. Yet the directive also states that a firearm may not be used “when the officer has reason to believe … that the discharge may endanger the lives of passersby, or other persons not involved in the crime, and the officer’s life, or that of another person, is not in imminent danger.”

THE OPEN RANGE

Armed guards have patrolled BART trains and stations since the agency started running trains about 30 years ago. At first, they were simply known as “BART Security”; the officers had the authority to carry weapons and arrest suspects, but under state law, they weren’t members of a real police department. For the most part, that limited their authority to the confines of BART property.

In 1976, the state Legislature granted BART the authority to run a police department with jurisdiction and authority second only to the California Highway Patrol. BART officers now have full police powers, not only on their own turf, but in every one of the 58 California counties.

The department, headquartered near the Lake Merritt BART station, currently employs 151 sworn officers and nine dogs (see sidebar Page TK). An undisclosed number work undercover, in plain clothes, riding the trains and looking for crimes that range from fare evasion, “eating,” and “expectoration,” to assault, robbery, and rape. By far the most common crime, according to a BART police statistical breakdown for 1992, is “vagrancy”: 4,227 separate instances were reported by BART officers in the first 10 months of the year.

The BART Police Department has a $12 million annual budget, a fleet of patrol cars, and its own communications system. Officers earn salaries that Chief Taylor calls “competitive” with other departments in the Bay Area.

And at a time when California law-enforcement agencies are coming under increasingly strict civilian control, the BART police operate with nothing more than token oversight.

Chief Taylor reports to no commission, mayor, or city council. The department is administered by BART’s assistant general manager for public safety, who reports to the general manager, who reports to the board. BART spokesperson Michael Healy said the board plays no role in hiring or firing a chief, much less in disciplining police officers.

Former BART Board member Arlo Hale Smith said that in his term of office, the BART police chief rarely showed up for board meetings. “Even when we had something to discuss about the department – usually a labor-contract issue – the assistant general manager would come,” Smith explained.

Citizen complaints against the BART police are handled by the Internal Affairs Department, which is not a separate agency, as it is in many police departments, but a branch of the Detective Division, Taylor told the Bay Guardian.

That, some critics say, may explain why BART has the lowest possible rate of sustained complaints against its police officers. “There’s a very good reason for civilian agencies to handle complaints against the police,” said the ACLU’s John Crew. “People who have been abused by the police have a hard time trusting the same police department to do an honest investigation.”

Cornelius Hall, who is no stranger to government bureaucracy, said he ran into a stone wall when he tried to get some basic information about his son’s death from BART. “They wouldn’t even give me the police report,” he told the Bay Guardian. “The only way I can find out what happened to my son is to hire a lawyer and have it subpoenaed.”

Crew said he finds the situation “chilling.” He said he saw a “complete dearth” of civilian oversight in the BART administrative structure. “There’s no opportunity for meaningful public input, for hearings, for discussion of issues,” he continued.

“It’s not an acceptable situation. But under the circumstances, the members of the BART Board have an increased responsibility to ask questions and keep on top of their police department’s practices.”

In the case of Jerrold Hall, at least, that doesn’t seem to be happening. The shooting hasn’t been on the agenda for any board meeting since Nov. 15, and board members say they haven’t received any information about it from BART management.

And unlike Cornelius Hall, they haven’t even bothered to ask.

TO TELL THE TRUTH

The day after a BART police officer shot Jerrold Hall in the back of the head, transit agency spokesperson Mike Healy told reporters that Hall had been shot in the chest.

Not true.

Healy also told reporters that Hall had attacked Officer Fred Crabtree, and continued to attack him after Crabtree fired a warning shot.

Not true.

And Healy said that the warning shot was fired “over Hall’s head.”

Not true, either.

Healy freely referred to an alleged “armed robbery,” but he didn’t tell reporters that BART police had searched the entire area and never found a gun. He didn’t say that the alleged robbery victim had vanished without a trace, either.

So the public got a one-sided – and, as it turns out, largely inaccurate – picture of the incident. The press, taking Healy’s information at face value, portrayed Jerrold Hall as a violent, gun-wielding punk, shot in the act of attacking a cop.

“In some ways,” says Hall’s father, Cornelius, “that’s the saddest part of all.”

And while Healy finally put out a statement Dec. 7 acknowledging that some of his previous comments were in error, he did so only after a three-week barrage of questions from the Bay Guardian – and he never issued a word of apology to the Hall family.

It’s hard to blame Healy for the initial round of misinformation: In the heat of a bloody battle, the truth is often obscured. But Healy clearly knew, or could have known, within a few days after the incident that his official press statements had been wrong – that, for example, the medical reports showed Hall had been shot from behind. He could have called the reporters who were covering the story and let them know, or issued a new press release with updated information.

He could have tried to rescue some of what was left of the dead 19 year old’s personal reputation – and salvaged a bit of his own in the process. Instead, he fell back on the old BART strategy: When in doubt, stonewall. Then duck for cover, and hope it will all go away.

The BART Police Department may be the least-responsive law-enforcement agency I’ve seen since the discovery of the shredding machine in the White House basement. There is no press officer. The watch commanders, lieutenants, and captains refer all press calls to Chief Harold Taylor, who won’t come to the phone; his secretary refers the calls to the BART Public Affairs Office.

When I first called Healy Nov. 16 to ask about the shooting, he told me he hadn’t seen a police report, and didn’t know if one existed. He also said he didn’t know what the citizen complaint procedure was for the BART police, and had no idea if it was in writing. I filed a formal request for those and other records Nov. 17; under the Public Records Act, I had a legal right to a response within 10 days.

I let it slide to 15 days (holidays and all), then started calling Healy’s office. He was too busy to come to the phone at first, but after I harassed him for several hours, he told me that Chief Harold Taylor was handling my request, and that I should call him directly. Taylor wouldn’t come to the phone at all: He had an assistant tell me that Public Affairs was handling the request, and that I should call Mike Healy.

I spent another day trying again to reach Healy, who finally told me he wanted to set up an interview with Taylor – for Dec. 4, 17 days after I’d sent in a request for information most police agencies would probably have provided in less than an hour.

Chief Taylor showed up for the interview with a BART lawyer, who promised that the chief would fax me a statement of the facts of the shooting sometime later that afternoon. The brief, incomplete statement finally arrived three days later, around 3:30 p.m. Dec. 7, 21 days after my initial request. And BART officials still won’t release the full police report.

If I were a suspicious reporter, I’d wonder what they were trying to hide.

Deputy dog

In Philadelphia, the Inquirer revealed several years ago, police dogs attacked 358 people in the course of 33 months, leaving many of them scarred or maimed for life. In Los Angeles, the Times recently reported, the local K-9 Corps recorded more than a thousand bites in three years. In Washington, D.C., and Baltimore, trained German shepherds tore into a total of 375 legs, arms, and torsos in the course of their law-enforcement work.

In the past 10 years, canine corps scandals have tarnished the reputations of police departments all over the country and have cost taxpayers millions of dollars in lawsuits.

In Berkeley, however, police dogs have been banned since the early 1970s, when a City Council member named Ron Dellums responded to the brutal use of dogs against blacks in the South with a resolution abolishing the local canine corps. In San Francisco, dogs handle only a few very limited tasks.

But since 1990, the BART Police Canine Corps has been expanding into the sort of work that created such extensive problems in other American cities – a use for dogs that critics say has little justification.

“There are two basic rationales for using police dogs,” explained Richard Avenzino, director of the San Francisco SPCA, whose agency has worked with the local Police Department canine program. “One is for sniffing out explosives or narcotics. The other is for searches, mainly in enclosed spaces, where the dog’s sense of smell can aid in finding a hidden human suspect.

“But there’s also a perception that a snarling dog can intimidate people, which creates a lot more potential for trouble.”

The first BART Police canine corps dates back to the early 1970s. But the BART Board disbanded the program in 1975, after a police dog on a train in Philadelphia barked at BART Director John Glenn.

In 1990, Police Chief Harold Taylor restored four dogs to the force, saying they would be “a strong statement of police presence,” would deter violent crime, and could be used to help clear homeless people from trains and stations. In an interview last week, Taylor said the dogs, which now number nine, are used “to back up officers, in all their law-enforcement duties.”

The dogs, imported German shepherds, are bred and undergo Schützhund training at a special school in Germany, where they learn to attack on command. “The dogs only [understand] German,” explained Deputy Chief Kevin Sharp. “The officers learn to issue their commands in that language.”

Sharp said none of the BART dogs are trained to sniff out bombs or drugs and that they aren’t often needed for searches. In normal situations, he said, the dogs stay in the police car, with the window open, while the officer approaches a suspect. “They’re trained to jump out and attack without any command if they see that the officer is under assault,” he added.

ACLU Police Practices lawyer John Crew found that description alarming. “In other words,” he said, “we have dogs deciding on their own when to use what amounts to lethal force. That’s not a very good idea.”

Avenzino said the training methods used for such dogs “are, to put it mildly, controversial. A dog will do anything to please its owner; if you teach it to attack on command, it’s like loading a gun. In my opinion, it’s very dangerous.”

Jim Chanin, a Berkeley lawyer who has filed several lawsuits over attacks by police dogs, said he sees no good reason for BART to have a canine corps. “The problem is that these dogs are just trained to attack,” he explained. “You can’t use them to search for some kid lost in the BART tunnel.

“If there’s something the BART police do on a regular basis that requires the use of dogs, I certainly can’t see what it is.”

Chief Taylor told the Bay Guardian that dogs provide much less expensive backup than additional sworn officers. Berkeley Police Lt. Tom Grant said he agrees, to a point: “But then you have to pay out those big legal settlements if one of the dogs does something wrong.”

Waning wildlife

GREEN CITY Changes to ocean and air temperatures, rising sea levels, loss of habitat, scarcity of food, altered precipitation patterns, environmental asynchronicity — these are the concerns of wildlife biologists who are watching the increased effects of climate change on the thousands of plant and animal species that share the earth with people. Overall, global warming threatens a third of existing species, with 50 percent now in general decline due to a variety of human activities.

Bay Area wildlife is already being negatively affected by a warmer world, one that locally manifests in nesting birds roasting to death during heat waves, plummeting fish populations, and starving whales. Those stories were part of "Irreplaceable: Wildlife in a warming world," a recent seminar held at the San Francisco Public Library by the Endangered Species Coalition. Maria Brown, superintendent of Gulf of the Farallones National Marine Sanctuary — one of the most biologically diverse regions in the world, shared a grim account of the Cassin’s auklet.

"This little seabird you maybe never heard of may predict the future of climate change in San Francisco," said Brown.

The auklet spends most of its life far out at sea, and flies inland to breed in burrows on remote islands and coastlines. Invasive grasses have choked many of the prime burrowing spots along the coast, so wildlife biologists have installed bird boxes as an alternative. April, the height of the annual nesting season, was an unusually warm month, with thermometers on the Farallones Islands clocking 90-degree temperatures. The bird boxes turned into ovens. "They literally cooked," said Brown of the breeding auklets. "This is a prediction of what’s to come."

The auklet’s story also shows how species have already been negatively impacted by human activity, even before dramatic climate change was factored into the equation. That’s a point all the speakers drove home.

"We’re dealing with these threats that already exist. Now with climate change we superimpose all these unknowns," said Tamara Williams, a hydrologist for the Golden Gate National Recreation Area, a 60-mile swath of incredibly diverse land spanning from Tomales Bay to San Mateo that is home to 34 threatened or endangered species — more than any other national park in continental North America. "Those listed species were listed without considering impacts of climate change. We’re dealing with species that were in trouble already."

And how will it affect other species that aren’t listed? Williams gave an example of the coast redwood, which relies on a foggy environment to stave off drought during summer months. Will the coast continue to be as foggy as it’s been in the past? "We wish we could predict what’s going to happen, but we can’t," she said.

Mike Lynes of Golden Gate Audubon said the Bay Area has global significance for birds, but there’s already been a 90 percent loss of its historic wetlands — one of the primary habitats for shorebirds, which are already in a 50 percent decline. Climate change is only going to make the world harder for them, he said as he flashed maps of altered land masses in the event of a one-meter sea level rise — the modest prediction for what will happen by 2100. The maps showed that such a rise will cause wetlands in Richmond, along the Petaluma River, and in Silicon Valley to disappear. Lynes pointed out that the reconfigured coast doesn’t allow room for new wetlands — the coastlines will butt up against already heavily developed urban enclaves for people.

But, he said, expanding and preserving wetlands would benefit birds and humans — wetlands mitigate flooding and are a high-quality CO2 trap.

Zeke Grader, executive director of the Pacific Coast Federation of Fishermen’s Associations, didn’t sound optimistic about preserving one critical wetland — the Sacramento-San Joaquin delta — when he spoke about the collapsed Pacific salmon population.

"We know pretty much what the problems are for the Central Valley salmon. It doesn’t take a blue-ribbon panel like the governor would like to appoint," he said. "We’ve affected most all of its lifestyle, its lifecycle, by blocking off the places where these salmon spawn," rattling off the names of dams and rivers — Shasta, Bryant, American, Feather — that are no longer easily passable for fish returning to lay eggs where they were born.

On top of that, eggs that are successfully laid hatch into fish that then migrate downstream where they encounter the delta, an "estuary beginning to die." There, agricultural runoff, limited freshwater, and powerful pumps all threaten fish survival.

The few salmon that make it out to sea are faced with altered currents, fewer cool water upwellings, lower quantities of food, and literal dead zones where pollution has obliterated the natural diversity of the water.

"We know what has to be done to fix it. What has been done? Absolutely nothing. Now comes global warming. How well are we going to respond now that we have global warming?" asked Grader. "This year there was no fishing for the first time since 1848," bringing the issue back to the basic human need for food, as well.

He urged people to start demanding more from elected leaders, including a stronger Endangered Species Act with a well-funded mandate, and to begin "raising a much higher bar if we expect to have salmon on the planet, humans on the planet, in the future."

At the start of the evening’s presentation, Representative Nancy Pelosi’s aide, Melanie Nutter, delivered a short message from the Speaker of the House calling global warming a moral challenge. Nutter didn’t stay for the presentation, however, and wasn’t there to hear speaker after speaker call out the government for lack of action and, in some cases, inappropriate action.

Tom Dey, a water policy analyst who was seated in the audience, commented that change might come from the top of Barack Obama’s administration, but local officials need to be lobbied. "We have Senator [Dianne] Feinstein and Governor [Arnold] Schwarzenegger, who have written off the delta," he said, bringing up their support for a $9 billion bond to build more dams.

All the speakers urged individual action as well, and Williams said the Interior Department was "committed to doing what we can to reduce our own carbon footprint."

So far, that has been an analysis of carbon emissions throughout the national park system. GGNRA recently approved its climate action plan and is just beginning implementation of three major phases: emissions reduction, education, and adaptation, according to Laura Castellini, an environmental protection specialist. So far, that has meant an energy reduction partnership with Pacific Gas and Electric Co., an integration of climate change into interpretations, and beginning a more focused look at how sea level rise will affect GGNRA lands.

There have been hurdles, too. Castellini said most of the park’s emissions actually come from visitors, so the organization is looking at ways to enhance shuttles to and through parks as well as encouraging alternative transportation to arrive there in the first place. When asked how GGNRA was changing its own driving patterns, she said the agency was having problems getting more fuel-efficient cars. "Right now we get all of our vehicles from the General Services Administration. They have been a little slow in getting us vehicles that get us closer to our goal." Specifically, GSA only offers flex-fuel automobiles that run on ethanol, a plant-based fuel that many environmentalists are criticizing as unsustainable. Furthermore, Castellini said there are no ethanol stations in San Francisco.

Even given the concrete actions the park system is taking, there are still a lot of big unanswered questions, said Castellini. What if Glacier National Park no longer has any glaciers? "What does it mean if our protected areas no longer protect what they were established to?" she asked.

The Irreplaceable campaign, which includes a photo exhibit (closing Dec. 31 at the Main Branch of the SFPL), is traveling the country, ending in Washington, DC, as part of a push for Congress to recognize the gravity of the problem. Mark Rockwell, director of the program, closed the seminar by saying, "The only constant in nature is change. Change is what we’re going to have to become more comfortable with."

That includes human change.
