The Bush administration plans to increase quota of Iraqi refugees allowed into the U.S. from 500 to 7,000 next year in response to the growing refugee crisis, according to the Guardian Unlimited.

Border policies are tightening because one million Iraqi refugees have already fled to Jordan and another one million to Syria. Iraqi refugees who manage to make it out of Iraq still can’t work, have difficulty attending school and are not eligible for health care. Many still need to return to Iraq to escape poverty, according to BBC news.

REVIEW Los Angeles has lately become quite a hot spot for queer studies scholars, their investigations slipping out of the Hollywood Babylon mode of starstruck speculation and into the lives of everyday Angelenos. In the wake of Lillian Faderman and Stuart Timmons’s well-received 2006 volume, Gay L.A.: A History of Sexual Outlaws, Power Politics, and Lipstick Lesbians (Basic Books), comes Daniel Hurewitz’s Bohemian Los Angeles and the Making of Modern Politics, an ambitious, fascinating attempt to show how Communists, postsurrealist artists, civil rights activists, and pre-gay "fairies" converged in the crucible of early 20th-century Silver Lake — then called Edendale — to create the modern notion of identity, in particular queer identity.

Bohemian Los Angeles is bookended by two extraordinary characters who made their home in Edendale: lauded vaudeville female impersonator Julian Eltinge and gay-rights giant Harry Hay. Both of these men had sex with other men, but they couldn’t have been more distant in their conception of their own identity. The idea of gayness, or the notion of a true inner self that relied on sexuality to achieve its public expression, was as alien to Eltinge and his time (the 1910s) as Grand Theft Auto. Despite the expensive stage gowns and fellatio, the otherwise macho Eltinge was enraged by the showy "cissies," dandies, and fairies who claimed to have "woman’s blood in them" and made up much of his fan base. For him and other prominent male-on-males, homosexuality was a private act that needed no community or publicity to ensure its satisfaction. Hay, who came to prominence 40 years later as the first official gay activist, was a different fish entirely. His Mattachine Society insisted that homosexuality was an underlying impulse knitting everyone who was "that way" into a kinship with a shared cause: civil rights.

Hurewitz’s project is to trace how Eltinge’s view gave way to Hay’s, how activity was transformed into identity and gay pride was born. To do this, he recounts the history of Edendale as one of transformative communities, paying close attention to the artists who gathered around guru Jack Zeitlin in the late 1920s and began exploring the idea of an inner essence that could be communicated through the arts. He looks at members of the Communist Party of Los Angeles who experimented in communal living in Edendale in the 1930s and, in the wake of World War II’s Zoot Suit Riots and Japanese internments, agitated for a notion of civil rights based on ethnic identity. And he tracks the growth of homosexual networks in LA, the prototypes of a community based on sexual desire.

All of these bohemian groups, Hurewitz argues, laid the groundwork for Hay’s and others’ ultimate politicization, their embrace of a sexual inner essence worthy of public declaration. A further inspiration was the steep uptick in homosexual arrests in the 1920s, as the city’s politicos seized on the notion of "degeneracy" as a moral-panic strategy. (One of Hurewitz’s fabulous insights is that the idea of degeneracy was once embraced by some homosexual men as a way to divorce their actions from their character.)

Many gays today feel exhausted by identity politics yet trapped in a ghetto of conformist sexual expression. Refreshingly, this sharply written, well-researched history brings to light some of the magically diverse, willfully perverse, and politically immersed foundations of who we are now. *

These days everyone is a gourmand, and caring about the earth is so cool it’s made even Al Gore popular. The time is ripe to give a fuck.

But all this focus on artisanal and organic products is complicated. What’s easiest for the consumer to understand isn’t always correct. Stickers can’t always be trusted. And — certified or not — nothing holds a candle to family tradition.

It’s true for tomatoes. It’s true for tangerines. And, according to Winnie Yu, director of Berkeley teahouse Teance, it’s especially true for tea.

That there is controversy or politics involved with tea is nothing new (Boston Tea Party, anyone?). But the most recent debates have centered around two primary issues: the practice of using lower quality teas in tea bags (versus loose leaves) and the consequences of labeling tea as organic.

But before we get into all that, first the basics.

CONFLICT BREWS


The beverage as we know it is said to have been discovered when tea leaves blew into the hot-water cup of early Chinese emperor Shen Nung. Cultivation started simply enough, under the fog on steep hills, where harvesters engaged in the art of fine plucking, or gently twisting the buds of Camellia sinensis at precisely the correct moment of the correct day. This knowledge was a biorhythm, pulsating in the bones, passed from one generation to the next.

But it wasn’t long before this Chinese medicinal crop changed everything. The British East India Co. — originally chartered for spice trade — spread opium through the region just to get its hands on the stuff. This bit of naughtiness made it the most powerful monopoly in the world, prompted wars, and left legions addicted to another intoxicating substance: tea.

Smuggling rings, high-society occasions, and ever-increasing taxes spiraled around the precious crop. The long journeys from China to Britain led to the glamour of clipper ship races, but below deck fighting the rats was another problem altogether. One piece of tea lore explains how cats were employed to catch the rats, and after an entire shipment of tea (already stale from the journey) was infused with cat piss, it was discovered that the pungent bergamot oil, popular at the time, masked this stench quite nicely. Earl Grey was born.

Next came Thomas Sullivan, New York tea merchant, good-time guy, and miser to the core, who decided to send some tea samples to faraway clients. Instead of packing his gifts in tins, as was common at the time, Mr. Tightwad decided to use some silk baggies he had lying around. The people who received these pouches assumed they were to dip them into boiling water and throw away the debris. Sullivan had unwittingly invented a no-mess solution to tea. The orders came pouring in. A few years later the Lipton tea bag was born.

BONES ABOUT BAGS


Eventually, it was learned that smaller pieces, or finings, brew more quickly than full leaves. But when leaves are broken into finings, the oils responsible for their taste evaporate. This leaves a bitterness that can only be countered with cream and sugar. And the tea farmers in China kept on keeping on, despite the series of near-triumphs, well-intentioned buffoonery, and colonial rebellion that resulted in the western side of the tea-drinking world forever asking, "One lump or two?"

According to tea connoisseurs, this is when the fine crop began its slide down the slippery slope into pure crap.

Far from an obsolete issue (or a localized one), bagged tea — both its quality and its form — has sparked a very modern worldwide debate.

In Sri Lanka as recently as Feb. 12, D.M. Jayaratne, newly appointed minister of plantation industries, instructed tea researchers and relevant authorities to investigate whether premium teas exported in bulk are being mixed with cheap tea.

And on the less quantifiable front, contemporary tea drinkers such as Yu consider bagged tea to have all the sophistication and allure of boxed wine. Properly enjoyed tea is not only an intoxicant but also an art. "It’s like music," Yu explains. "The notes have to be appreciated at their own time."

Tea bags pilfer quality by design, but something bigger may be lost between the staple and the tag: how about a bit of ceremony in a racing, relentless world?

"Tea is a spiritual product, as well as for consumption," says Yu, who has made it her mission to bring fine tea and tea education to the Bay Area. "It was a medicine for 2,000 years before it was a beverage."

Her Berkeley tearoom — a serene, beautiful environment flecked in copper and bamboo — allows you to connect with the leaves, the culture, the moment, and the community. "Drinking with 3,000 years of history, you don’t feel alone," Yu says.

THE ETHICS OF ORGANICS


Meanwhile, at the 40th annual World Ag Expo in the San Joaquin Valley in mid-February, cannons thundered, Rudolph Giuliani waxed poetic about alternative fuel, jets split seams into the sky, more than 100,000 people gathered from 57 nations, and a small group of farmers met to contemplate the agribusiness plunge into the emerging organic industry.

During a seminar with Ray Green, manager of the California Organic Program for the California Department of Food and Agriculture, these farmers had before them a daunting question: organic at what cost?

When it comes to tea, Yu has an answer. The cost is large: to consumers, who mistakenly think their certified-organic tea bag is superior to the noncertified (but tastier and ecofriendlier) independent variety, and to small farms, which have to compete with the certified giants.

Artisan tea shops such as Yu’s depend on strong bonds with small farmers. But most quality tea farms opt out of the bureaucratic mess of US Department of Agriculture organic certification because the fees are too high and the other costs are too great. For example, USDA certification can require land to lay barren for up to five years. According to Yu, it’s nonsense to ask a family farm to participate in such a thing. "These hillsides have had tea growing on them for hundreds of years," she says. "It is very precious to have a tea tree."

Many new farms are certified under European and Chinese regulations — which are both significantly stricter and cheaper than their United States counterpart — but still have to compete with big corporations willing to jump through the USDA hoops.

At his seminar Green said, "Some of the farmers that left conventional agriculture 10 years ago because they just couldn’t compete on economies of scale are now finding that the same companies they were in competition with 10 or 12 years ago are now competing against them in the organic sector."

Consumers want to choose certified products because they think they’re doing the right thing. But doing so doesn’t necessarily help anyone but the big corporations that can afford certification.

"Organic isn’t an issue if it’s always been organic," Yu says. "Fair trade is not an issue [for Teance] because we buy from family farms."

Yu works with family farms like the ones with representatives sifting through the advice and cautionary tales of the World Ag Expo, the farms wondering how to stay afloat in the wake of impossible competition. As their corporate counterparts lurk in low valleys, sifting the scraps of their mass harvest into nylon bags before slapping a USDA organic sticker on attractive packaging and trumpeting health consciousness to the uneducated consumer, the folks on the hill are still doing what they’ve always done.

It’s clear that as consumers become more informed, the demand for quality product increases. With this demand comes profit, red tape, and a departure from the salt-of-the-earth spirit that gave birth to the organic movement.

"The ritual is authentic, healthy, artful," Yu says. "You can’t find that in a tea bag."

So what is the San Francisco tea lover to do? At the very least, you can support your local gourmet tea peddlers. From Chez Panisse to El Farolito, the Bay Area is uniquely qualified to appreciate the culinary good stuff. We like it slow, whole, and artisanal, and fine teas deliver. *

Never mind the ides of March, here comes year four of the Iraq War. Believe it or not, this whole illegal invasion-and-occupation business brought to you by the generally scary US government — that consortium of oil companies, political marionettes, neoconquerors, military wonks, and other capitalist heavies operating behind the flimflam of democracy and terror — is about to celebrate another birthday. (In various offstage boardrooms, we hear the muffled sound of champagne corks not so discreetly popping.)

It’s unclear how many people are still fooled by the flapdoodle spewing from the faces fronting for this enterprise. For most of us in the big Green Zone back home, questions about the Iraq War have moved decidedly into the cultural realm, where the conflict lingers and ferments like others before it in the atmosphere generated between the TV and the dinner table — or, more insidiously, in the mute wasteland of adolescent malaise, surrounded on all sides by a dysfunctional society in lofty denial of its serious penchant for destruction.

Although written in the aftermath of the Gulf War, that media-sanitized prequel to contemporary carnage, playwright Mickey Birnbaum’s Big Death and Little Death squarely occupies the latter territory. But suburban death metal–laced teenage angst is more than the terrain of Birnbaum’s sly and ferocious black comedy — now enjoying a feisty West Coast premiere by Crowded Fire — it’s a beachhead from which the play gleefully lays waste to the universe as a whole.

Birnbaum’s fully fledged two-act (originally intended as an opener for death metal bands) posits some distorted family values, amplified by the sublimated horrors of a world on fire. Its main characters are a brother and sister, Gary (Carter Chastain) and Kristi (Mandy Goldstone), two sympathetically screwed-up teenagers whose modest nuclear household (an evocative panorama of linoleum, Formica, and faded wallpaper in Chloe Short’s deceptively spare set design) is vaguely overseen by their father, a troubled Desert Storm vet (Lawrence Radecker). Since returning from the Gulf, Dad likes to take pictures of road accidents (your quiet, volatile type, in other words, wonderfully fashioned by Radecker as an opaque yet sympathetic psychopath in desert fatigues). Completing the picture for a time is Mom, or Dad’s unfaithful wife (Michele Levy), whose history of sexual indiscretion while her husband was off sauntering through hell comes tumbling out of her in a series of Tourette’s-like confessions.

In the role of a highly inadequate support circle are Gary’s friend Harley (Ben Freeman), an awkward adolescent with an ambivalent thing for his friend’s sister; Gary’s twisted guidance counselor, Miss Endor (Tonya Glanz), who invites him to a death metal concert before diving into a crank-fueled nihilist rant; and Gary’s inappropriate Uncle Jerry (Michael Barr), a Navy sailor who becomes even more inappropriate as the oxygen leaves the stranded sub from which he makes a farewell call.

When a litter of pups is carted off by a classic suburban tweaker (Barr) in exchange for a gun and a bag of drugs, one of the pups (Mick Mize, in a dog suit) is left behind somewhere to haunt the house and mind of the posttraumatic paterfamilias. This subplot is interspersed with scenes from a family car trip from hell and Kristi’s anorexic adolescent anguish as Gary ponders whether to go to city college or "destroy the universe." In the end, as the characters make love, war, art, and friends in no particular order, the second option looks increasingly enticing to our hero, if only to clear the way for something new.

Smartly staged by Sean Daniels (moonlighting from his position as associate artistic director at the California Shakespeare Theater), Big Death and Little Death speaks to this imploding universe loudly and affirmatively, forefingers and pinkies extended. In Birnbaum’s optimistic apocalypse, there’s a difference between the annihilation of the system and the creative destruction that envisions a new beginning on the horizon.

The umbilical link between big and little deaths brings to mind the Vietnam-era "little murders" in Jules Feiffer’s even more prescient black comedy of an American culture of self-destruction. One’s tempted to call Birnbaum’s play the Little Murders of our day.

But neither can really compete with the culture they so sharply critique nor prove as strange or fitting as the news of the dean of West Point ganging up with human rights activists, the FBI, and military in-terror-gators to chastise the creators of 24 for feeding US soldiers too many tantalizing torture techniques. Seems almost a chicken-and-egg problem at times, this relationship between big death in Iraq (and Afghanistan and beyond) and little death on the tube. It’s quite a food chain too, bringing to mind that serpent devouring its own tail. Come to think of it, Ouroboros would make an excellent name for a death metal band. *

Director and cowriter Bong Joon-ho insists that The Host is not really anti-American, and I’d agree. More accurately, it offers an incisive take on US foreign policy, echoing 2004’s double punch of Fahrenheit 9/11 and Team America: World Police. The key difference is that The Host isn’t homegrown, so it’s not dabbling in self-satire. Instead, it reflects how an outside nation (in this case, South Korea) views the US obsession with controlling absolutely everything on the planet.

The Host approaches the theme by depicting how a foreign city in crisis reacts to a pudgy, galloping sea monster birthed by American neurosis. The film opens in the morgue of a US army base in South Korea, where the Yankee in charge instructs his Korean underling to discard hundreds of gallons of toxic liquid. "I hate dust more than anything," he explains, wiping dirt from the glass bottles. When his assistant protests, pointing out that the chemicals might end up polluting the local river, the American won’t listen. "Pour them right down the drain," he says.

The best part is that this really happened, kind of. A January 2005 Korea Times article reported the following: "A local appeals court on Tuesday sentenced Albert McFarland, an American civilian employee of U.S. Forces Korea (USFK), to six months imprisonment, with the term suspended for two years, for instructing his subordinates to dump a toxic substance into the Han River in Seoul in 2000." The toxic substance was 227 liters of formaldehyde, which is more than enough to freak out environmentalists and probably quite close to the real amount needed to create some kind of monstrous Han River mutant — or at least inspire Bong to dream one up. It’s not as dramatic as Godzilla‘s nuclear birth, but it’s plenty sinister nonetheless.

The next American in the film surfaces right when the monster does. He just so happens to be an out-of-uniform US soldier who helps The Host‘s schlubby antihero, Gang-du (Kang-ho Song), brain the creature with a traffic sign. Turns out, thanks for nothin’, dude: as news broadcasts inform us throughout the film, the soldier becomes mysteriously ill with a virus attributed (by the US military, naturally) to the mutant. That the creature represents some kind of bioterror smacks of propaganda; it’s made all the more suspicious by the fact that Gang-du, who endured a face full of sea-monster blood, remains completely healthy.

The Host‘s central concern is Gang-du’s family, who spend the film frantically searching for the thirtysomething slacker’s much-beloved daughter after she’s snatched by the monster. Bong insists his movie isn’t trying to point fingers at any specific targets but instead is framing its conflict as more of an us-versus-them dig at society (see "God of Monster," page 58). But The Host does emphasize America’s meddling military presence in Korea. Who else would advocate such over-the-top quarantine and security measures, other than the country that won’t even let you stash a shampoo bottle in your carry-on? Who else would greet violence with violence, plotting destruction (without spoiling the plot, let’s just say even more dangerous chemicals are involved) and blithely ignoring peace-minded protesters? America … fuck yeah!

So far, no American fascists — you know, the people who got their knickers in a knot over the Dixie Chicks — have come out against The Host; presumably, Korean monster movies are far removed from any Fox News–fueled radars. A Wikipedia article on The Host pointed out a particularly amusing reaction, though: it seems North Koreans (memorably mocked in Team America) are diggin’ the film’s perceived slam against the United States. According to the cited Yonhap News article, dated November 2006, "North Korea gave a rare compliment to a South Korean blockbuster movie on Thursday, upholding its critical stance toward the U.S. troops stationed in the South and dubbing them the ‘monster of the Han River.’ "

It gets better: "’The movie portrays realistically and through impersonation that the American troops occupying South Korea are the monster that steals people’s lives and destroys their happiness,’ North Korea’s weekly magazine Tongil Sinbo said in its latest edition."

Obviously, Bong’s intention when making The Host was not to stoke North Korea’s already abundant hatred of America. (It’s a testament to the film’s huge home-country success that even its pop culture–deprived neighbors took note of it.) Still, the film makes an effective point about monsters who invade where they’re not wanted — and the undeniable amount of devastation they leave behind. That Bong wraps his message in the tentacles of a sea monster (and a damn enjoyable movie, to boot) makes it all the more potent. *

The sushi house rules

An old rule of prudence teaches that you should never eat raw oysters in a month whose name doesn’t have an "r" in it — from May to August, more or less — the warm-weather months elevating the danger of spoilage. Rain and cold do present their inconveniences and discomforts, but they are also balm in the matter of seafood, most of which is delicate and turns bad easily if the temperature starts to rise. One does not like to think of oysters being hauled along I-5 on some infernal July afternoon.

The rule has never been extended to sushi, so far as I know, but it wouldn’t be the worst idea. Although my best sushi experiences have been in balmy Hawaii, and while I have eaten raw seafood here in every season, even our autumnal summer, I am most at ease doing so in winter, when the world itself seems well refrigerated and the albacore tuna, plucked from cold seas, is rushed to the chilly city, where we eagerly await it in a restaurant that, perhaps — with any luck — is well heated.

Barracuda Sushi, which opened last year on a glam stretch of Market Street that includes Café Flore, Bagdad Café, and Lime, is well heated. It is also quite nice looking, with a rust and jade paint scheme, banquettes upholstered in fabrics with fine geometric patterns, and bars fore and aft (the latter a sushi bar). The place is less clubby-looking than Lime (which is a door or two away), but there’s a powerful nightlife pulse nonetheless. If you knew this space as the onetime home of such restaurants as Tin Pan and Repastoria Satyricon, you might not recognize it.

It is one of my pet theories that oft-flipped restaurant spaces at last achieve stability when they become Japanese restaurants. Après le déluge, sushi. Houses of Japanese cuisine must fail occasionally, but the attrition rate is low. So Barracuda (which has a pair of sibling restaurants down the Peninsula) opens with at least one structural advantage.

Another plus, more sensual or aesthetic in nature, is the swirling of Peruvian and Brazilian touches into the food, a reflection not of the kitchen’s whimsy (or not just of its whimsy) but of the large Japanese migrations to South America in the first half of the 20th century. Who could forget that a recent president of Peru bore the unlikely name Alberto Fujimori? Of course, he was forced out in disgrace, but still.

A nice introduction to this pan-Pacific sensibility is the sushi napoleon ($11.95), a disk of rice about the size of a single-serve cheesecake topped with chunks of tuna and avocado — a pair of roll regulars — along with blueberries, slices of mango, and a slathering of mayonnaise. It sounds awful, like something a latchkey kid might throw together as an after-school snack, but it turned out to be both beautiful (with the colors of some elaborate ice cream confection) and tasty-rich in a way Japanese food seldom is.

Most of the food isn’t so aggressively inventive. Gyoza ($5.95), the Japanese pot stickers, are familiar and friendly, though we found the skins to be thinner than usual, and the ponzu sauce on the side was spiked with some minced jalapeño pepper for added excitement. Seaweed salad ($6.95) was presented as an upmarket trio, with three varieties of seaweed (wakame, goma wakame, and hijiki) given three saucings of aji amarillo (mayonnaise-like and made from the mild yellow Peruvian chile), orange tobiko, and lemon. A sushi set ($11.95) consisted of California roll (crab and avocado) and a selection of nigiri, including tuna, salmon, and shrimp; it was good, but you could get it anywhere, even at the supermarket.

But even the fanciest supermarket probably wouldn’t offer anything to compare with the hamachi ceviche ($11.95), the thin bricks of flesh doused with a basil-yuzu-wasabi sauce — truly a New World combination, which produced a memorable sweet pepper-fire effect — and topped with tiny cubes of purplish bronze geutf8 — like jewels — we could not identify. Also distinctive are many of the rolls, including the Barracuda crunchy roll ($12): broiled tuna and avocado wrapped in a long tube of rice, which is then dipped in a light batter and flash-fried. The result is something like a Japanese chimichanga, tasty but quite rich.

We tend to associate Japanese cuisine so strongly with uncooked seafood that we are at risk of forgetting that the Japanese cook a lot of their food too and with their own sort of élan. The lunch menu offers us a series of vivid reminders of this, from udon (the pho-like noodle soup) to various types of panko-crusted cutlets, or katsu. There is even a breaded calamari steak (the poor man’s abalone), which turned up for me in a bento box ($9.50) in the company of a California roll, a pat of white rice, a mixed salad with creamy dressing, and (most welcome on a leaden, tule-fog day) a bowl of miso soup on the side. Across the table, miso soup was neither necessary nor missed, for there came a great bowl of udon ($9.95), steaming like a caldera on some volcanic plain. In the concentrated chicken broth lurked a Medusa’s wig of fat noodles, with flecks of shiso and scallion and slivers of shiitake mushrooms. The tempura shrimp were presented on the side, and we briefly considered the likelihood that we were expected to dump them into the bowl. We didn’t, and they turned out to do nicely when eaten on the side … but had we broken a rule? *

What exactly is Gavin Newsom doing at Delancey Street?

It’s not counseling, we’re told. It’s not rehab. It’s not detox. It’s not a typical course of treatment at the storied $20 million nonprofit. So what is it beyond a reprieve from the otherwise ugly headlines?

Newsom isn’t talking much about his program. But some mental-health professionals are raising serious questions about his regimen.

San Francisco’s chief executive declared several weeks ago in a public announcement to all the city’s department heads that he was seeking a diluted version of rehab at Delancey Street.

That struck more than a few people as odd. Delancey Street doesn’t do part-time or outpatient treatment. It only takes clients who agree to a long-term, full-time residential program geared entirely toward hardcore alcoholics, drug addicts, and criminals.

It’s not, in other words, a place where someone in Newsom’s condition would typically seek help. And it’s not a place designed to alleviate a comparatively minor thirst for white wine.

The news certainly appalled Dee-Dee Stout.

Stout is a City College of San Francisco professor and an adjunct faculty member at San Francisco State University. It’s her job to train city employees working in any major capacity that involves medically treating alcohol and drug abuse, from San Francisco General Hospital to Community Behavioral Health Services to the Adult Probation Department.

Stout, a certified drug and alcohol counselor, told us friends who’d seen the headlines said, " ‘Oh god, Dee-Dee’s going to hit the roof on this one.’ And they were right."

She struggled to figure out how she could broach the subject to one of her classes at City College — but a student beat her to it, quickly pointing out that it was unethical for credentialed treatment specialists to counsel their close friends. The two-year recertification required of caseworkers in the city includes an ethics update, Stout said.

Delancey Street’s executive director, Mimi Silbert, has been Newsom’s friend since he was a child and knows his father well. Silbert, in fact, has openly discussed Newsom’s progress with the press, including the Guardian, while the mayor’s own ear-piercing silence on the matter enables him to appear repentant.

Stout decided to offer the student extra credit if he drafted a letter outlining the concerns of the class, which she had colleagues review before sending it along to the entire Board of Supervisors, the Mayor’s Office, and pretty much every major newspaper in town.

"This relationship is not acceptable under any applicable code of professional ethics," the letter states. Hardly anyone bothered to write back, save for the auto-response letters Stout received from Sophie Maxwell and the Mayor’s Office, plus a letter from Bevan Dufty urging Stout and her students to empathize with Gavin during this difficult time.

Silbert, for her part, told the Guardian that ethics weren’t a concern for her because Newsom wasn’t a full-tilt drunk and hadn’t submitted completely to a detailed treatment plan when he approached her for help.

"The mayor is not a drug addict," Silbert said. "That’s not what he was looking for…. Having stopped drinking, he wanted to take a look at himself. He drank what people would call ‘socially.’ I’ve seen other people when they stopped drinking — even people who didn’t need detox — and there were physical signs of problems. That’s not the shape the mayor was in."

The mayor is attending both group and solo counseling sessions after work each day, a schedule that Silbert told us is still ongoing.

Dannie Lee, a former Delancey Street resident we interviewed, said that during his own stay he attended group therapy three days a week and they were generally no-holds-barred sessions. Lee lived at Delancey Street for three and a half years after spending much of his adult life in California’s prison system. While the program ultimately worked for him, he insists, he’s skeptical that it could benefit anyone who’s trying to attend as an outpatient.

"Maybe it would be great if [Newsom] was actually there as a client or whatever to really sit in a circle and really share his stuff and listen to the group and let the group really attack," said the 49-year-old Lee, who today is one of Stout’s students. "That probably would be fine. But I don’t see that happening…. I think he would really have to tell things I don’t think he wants to tell."

Press accounts have depicted Delancey Street as an abrasive scrub brush for Newsom’s sinful indulgences. "No Nonsense: Toughness Key to Delancey Street, Silbert’s Success," a Chronicle headline announced Feb. 7. Silbert herself told the Guardian, "No one would come near us if they weren’t serious. I’m old, crotchety, and very direct. I have no time to waste."

That may be true — and it’s clear Delancey Street has had some remarkable success in treating people with severe self-destructive impulses.

San Francisco, on the other hand, years ago eschewed the sort of harsh treatment techniques that have made Delancey Street famous.

H. Westley Clark, director of the federal Center for Substance Abuse Treatment and a one-time clinical professor at the University of California at San Francisco, told us that federal mental-health bureaucrats are less inclined today to fund groups that use confrontational methods for treating clients.

Any local nonprofit agency that wants to provide help to substance abusers using city money must comply with San Francisco’s harm reduction policy, which discourages hostile interview techniques and was set in stone by the San Francisco Health Commission seven years ago.

The letter from Stout’s class points out that treatment professionals are moving away from tough-love verbal upbraids such as those employed by the Delancey Street model.

" ‘Attack therapy’ often involves yelling at patients who have, in our view, a medical condition…. While we realize that some patients are helped by strong, confrontational methods, we believe that an evidence-based approach offers more consistent successful results."

Silbert’s techniques may be controversial, but she does move easily among Democratic Party rainmakers and philanthropists. Delancey Street enjoys wide popularity with the likes of Robert Redford, Sen. Dianne Feinstein, the Washington-based Eisenhower Foundation, and executives at the Gap, Pottery Barn, and Bank of America.

Silbert said the mayor deserves credit for whatever help he chooses to pursue. Other prominent friends of Delancey Street have called her before when they needed to "tune themselves up."

"I would never choose to criticize other people’s approaches, so I’m sorry if people are criticizing ours," she said. "We work hard. We do our best…. I’m glad these people feel they have a definitive answer. I don’t, and I’ve been doing it for 35 years."

If Newsom, as Silbert says, isn’t a serious alcoholic, Delancey Street is a peculiar place for him to seek help.

Most people entering the program have hit rock bottom, a step away from death or lifelong incarceration. They’re one-time prostitutes, drug pushers, robbers, and ruthless bangers. Since the organization was formed in the 1970s, it claims to have transformed the lives of 14,000 people through vocational and education assistance in addition to group counseling.

Very few of those people come in for the sort of casual treatment Newsom is seeking. In fact, Delancey Street typically doesn’t accept anyone who isn’t planning on spending a couple years in residence.

Residents living at the Embarcadero Triangle provide labor for several businesses that buoy the nonprofit financially, from its famous Delancey Street Restaurant to a national moving and trucking service.

Newsom for the most part is refusing to answer questions about his now-public battle with booze.

But Stout suggests that Newsom, by allowing the entirety of his treatment to appear on a marquee, has brought the publicity on himself. "Frankly, I don’t think it’s any of our business if he goes to treatment," Stout said. "I wish he would have just quietly gone and did what he needed to do and said he just had some medical things he needed to take care of, period." *

The Wild, Wild West

As a production assistant for a visual effects studio, Robert Seeley had a job at the Orphanage that was nuts and bolts for the movie industry — handling paperwork, overseeing schedules, arranging deliveries, and making sure folks were fed, clients were happy, and many of the million little logistics for a film project were coordinated.

His days began with an hour-long commute from Pleasant Hill to the Presidio, where the Orphanage is based. Mornings started around 9, and the typical workday ran about 10 hours. Or it did when he started there, in July 2006.

"There was a snowball effect. It started out as a regular 10-hour workday. It slowly built to 12, then 16," Seeley told the Guardian.

At one point, Seeley charges, he was asked to work a 20-hour shift — and return to work two and a half hours later. When he didn’t come in, he was fired.

Seeley sued, and the case was eventually settled. But along the way, the lawyers for the Orphanage raised a startling argument: since the Presidio is a federal enclave, they said, California labor law, which restricts the length of shifts, doesn’t apply.

"This was a really straightforward, meat and potatoes case," Seeley’s lawyer, Steve Sommers, told the Guardian. "And if he worked across the street, it would have been a slam dunk."

If the legal argument advanced by the studio as a response to Seeley’s lawsuit is right — and some labor experts say it may very well be — then none of the private companies that lease space at the Presidio have to follow any state or local labor laws. That means no California or San Francisco minimum wage, no workplace safety statutes, nothing. And since state law is generally far tougher than federal law, the difference could be profound.

There are hundreds of people working for private companies in the Presidio, which operates under a unique arrangement that allows private, commercial development in a national park.

Federal regulations are almost always weaker than California’s — and not necessarily improving. "Federal laws are evolving backwards for the most part," said Katie Quan, associate chair for Labor Research and Education at UC Berkeley. "There have been attempts to weaken benefits, Social Security, who can and can’t join unions. Even the new minimum wage that’s been passed — there’s a big question as to whether or not [George W.] Bush will sign it."

While California’s minimum wage is $7.50 and San Francisco’s is $9.14, the federal hourly rate is currently $5.15 — and arguably the only one that applies in the Presidio.

Several employment lawyers contacted by us initially suggested that California’s labor statutes would have to apply in the Presidio, but Chris Cannon, a lawyer familiar with the situation, did not.

"I’ve gotten a lot of people acquitted on a criminal basis applying that same validity," he said of the cases the Orphanage’s lawyers used to back up their argument. "It’s like a little piece of Nevada here in California."

Cannon has litigated several cases in the Presidio, most notably on the controversial issue of where and when dogs can be off leash. "Given the history of the Presidio, I think there’s a very good argument that California laws don’t apply."

It’s easy to extrapolate that nothing that’s been passed in Sacramento or at City Hall would apply to the Presidio, including the recent universal health care plan passed by the Board of Supervisors and the paid sick-leave that voters approved.

The upshot: the author of the bill establishing the Presidio park, House Speaker Nancy Pelosi, who is a big favorite of organized labor, may have created a place where private employers can freely flout state and local laws designed to protect workers.

Lieutenant Jeff Wasserman of the US Park Police, which has exclusive jurisdiction over the Presidio, said, "We only have to follow federal laws. However, the US attorney has in the past asked us to adhere to state laws simply because they think it’s the right thing to do."

One of Wasserman’s examples involved a California law that speed limits may only be adjusted based on recommendations from a traffic engineer, which was established to prevent cops from setting speed traps. To Wasserman’s knowledge, California is the only state with this restriction, and it’s been extended to the Presidio. "The US Attorney felt that it was fair that if the surrounding streets followed it, we should too." He added that juvenile arrests in the Presidio have also stood up in local courts because the federal laws are so weak in that regard.

Two dozen companies contacted by us were asked questions regarding employment protocol, and all said they paid San Francisco’s minimum wage or better and insisted they followed both federal and state labor laws. The largest employer in the Presidio, LucasFilm, did not respond to the questions.

Carsten Sorensen, CEO of the Orphanage, said, "We follow the letter of the law. We were told by our attorneys, being in the Presidio, we fall under the federal labor law."

He did say, "Of course we want our employees to be safe and do whatever we can to make sure that happens. There’s no chronic issue of people who are dissatisfied with the working conditions."

But in responding to the lawsuit, his company didn’t even try to defend its practices. Instead, Judith Droz Keyes, a lawyer with the firm Davis Wright Tremaine, argued in a Jan. 24 letter that "California has no jurisdiction either to legislate or enforce its laws within the federal enclave. The fact that the Orphanage is a private company leasing space within the Presidio makes no difference."

The Presidio Trust — the semiprivate agency that manages the park — did not respond to requests for comment, and it’s unclear how the outfit treats its own workers. Discrimination based on sexual orientation, for example, is not a part of the federal Equal Employment Opportunity laws, but it is a part of California’s, and even the Presidio Trust’s own personnel manual mandates it.

To require anything definitive and absolute would take an act of Congress to mandate the Presidio adhere to state or local ordinances. We tried to reach Pelosi’s office to ask about it, but she didn’t return our calls.

In the meantime, Sommers said, "The Presidio Trust could insist that all vendors abide by California state labor laws. Then large employers in the Presidio would have to treat their workers like citizens of California." *

Law enforcement’s real battles

OPINION In order to be smart on crime, law enforcement needs to make important choices about where to focus our resources. Unfortunately, the Bush administration has been making poor choices, and those choices are hitting home in San Francisco.

Recently, Immigration and Customs Enforcement (ICE) has conducted raids in San Francisco and around the Bay Area, rounding up immigrants at their jobs and schools, in some instances with ICE agents announcing themselves as police. These actions sow fear in the immigrant community among undocumented and documented residents alike.

The raids conducted in San Francisco present many of us in local law enforcement with a great concern. One of law enforcement’s biggest challenges to protecting crime victims in immigrant communities is encouraging them to come forward. Because immigrants are often afraid to report crimes, they can be regarded as easy targets for violent criminals and con artists.

We all suffer when crime victims are isolated from law enforcement. If victims and witnesses do not report crimes or cooperate with law enforcement, criminals remain on the streets, and all of us are put at risk. That is why my office is holding immigrant resource fairs in the Mission District and Chinatown to support immigrant rights and to make clear to community members that they are protected by San Francisco’s Sanctuary Ordinance and that my office will not report them to ICE when they come forward as witnesses or victims of crime. Rather than driving immigrants deeper into the shadows, we need to encourage those who have been victimized by crime to work with us to hold criminals accountable.

At the same time, the US Justice Department is walking down an ominous path by threatening journalists with prison time when they protect their confidential sources. In San Francisco the US attorney has held journalist Josh Wolf in prison since September 2006. Wolf should be released. For very good reasons, 31 states, including California, have shield laws upholding the rights of journalists to protect the secrecy of their sources and unpublished information. We need a federal shield law as well.

Of course, I believe crimes against police officers should be aggressively prosecuted. But I also believe that federal authorities have an obligation to respect the First Amendment. Free speech rights are critical to the work of journalists, university researchers, organized labor, and all of us in a democracy. The Justice Department should recognize the importance of protecting free speech, not only as constitutional and civil liberties issues but as smart public safety policy. Journalists play a key role in connecting us to individuals with information about crimes, and threatening the confidentiality of their sources has a chilling effect. If sources fear their confidentiality will not be protected, they will be less likely to come forward to journalists with information that could expose corruption or assist us in solving violent crimes.

Cities across the country are grappling with serious gang violence. Precious resources should be focused on addressing violence, gun crime, and major white-collar crime, not wasted on prosecuting journalists and conducting immigration raids that sweep up innocent residents, actions that hinder our efforts to build trusting relationships with vulnerable, victimized communities and keep the public safe. *

It’s funny: the transcontinental railroad was born in San Francisco, and it transformed California. But the West Coast has pretty much lost the train thing. You want to go from here to Los Angeles, there are pretty much two choices: you can fly or you can drive. In theory, you can ride Amtrak, and I’ve done it, but it doesn’t run very often and takes about 12 hours. Fun, if you like that sort of thing, but not at all practical.

But on an early Sunday morning last week, I was traveling from Washington, DC, to Philadelphia, and between 8 a.m. and noon there were about half a dozen trains running on that route. The high-speed Acela got me to Philly in 90 minutes, downtown to downtown, way faster than I could drive. Another hour or so, and I could have been in Manhattan.

There are flights from Washington, DC, to New York, but these days it seems kind of silly to fly: by the time you arrive at the airport, get through security, go up, go down, deplane, and get from the airport to the city, you’re well beyond three hours. The train’s way cheaper too.

Yeah, I love trains (actual legroom, no seat belt signs, scenery, bar cars), so I’m biased, but it seems silly that California is spending billions of dollars on highway projects (including a new bore for the Caldecott Tunnel, a colossal waste if there ever were one), and we still aren’t talking seriously about high-speed rail to Los Angeles, which would probably bring more environmental and economic benefits than all of the other transportation projects in the state put together.

There are plenty of reasons to wring your hands over Assemblymember Mark Leno’s decision to challenge incumbent state senator Carole Migden in 2008. The race will almost certainly be bitter and ugly; both sides have an incentive to go negative. It could split the queer community, leave progressives wondering whom to support, and turn political allies into enemies.

Or maybe it won’t: I wonder if San Francisco’s progressive community is mature enough today to handle this without any bad long-term impacts. Some of the city’s left leaders will back Leno, and some will back Migden, but in the end, neither one of these candidates is the enemy, and if everyone keeps a sense of perspective (the way we were able to do in the District 5 race in 2004), it doesn’t have to be a bloodbath.

I realize that Leno is running in part because of term limits, which might not be the most noble of motivations. And I’m against term limits. But there’s actually a reason to be happy about this race: it’s a demonstration that old-style machine politics is dead in San Francisco.

Ten years ago this race would never have happened. Willie Brown was in charge — really in charge — and no local Democrat would have dared to defy his will. Brown didn’t like contested races between Democrats, and he would have told one of the two candidates to back off, and that would have been that.

We live in a different political world now. Mayor Gavin Newsom will probably support Leno, but he has way too much on his mind right now to be involved in any kind of backroom deal. Neither Migden nor Leno has the kind of clout to scare the other away, and nobody else in this town does either.

Democracy isn’t always pretty, but after living under the machine for a couple of decades, I find this almost refreshing. *

Making Lemonade of the Chron’s Lemon

It’s hard to stay in the public eye when you’re stuck in jail and denied in-person and on-camera interviews, as freelance journalist Josh Wolf has been for the over six months. So, I have to give it to Chronicle columnist Debra Saunders for reminding everyone of Josh Wolf’s plight, even if what I really have to give Saunders is a Lemon Award.

Saunders tries to spin Wolf’s case with the old smear that Wolf isn’t really a journalist. It’s a spin that began in the SFPD and the US Attorney General’s Office, as the Bay Guardian discovered months ago, but doesn’t stand up to scrutiny. The minute Wolf sold his footage to KRON-TV, his work qualified as news. And journalism is about gathering and spreading the news, not sitting in a corporate headquarters and drawing a pay check to write spin.

Saunders also tries to smear Wolf by belittling his efforts to tell stories compared to those of “real journalists, such as the Chronicle’s Lance Williams and Mark Fairanu-Wada.” If Saunders is going to refer to the whole “confidentiality source agreement” business, then maybe she should remind readers of the whole sordid story behind that affair.

Next, she tries to smears Wolf case by accusing the Board of Supervisors of not having done everything they could to find out who attacked Officer Peter Shields, who was out of work for a year after his skull was fractured during the protest that Wolf filmed. Too bad, she didn’t figure out that
investigators have federalized the case on bogus grounds
: there was no arson of a police car, just a broken taillight. But, hey, how else were they gonna get around California’s reporter shield laws. (Other than by claiming that Wolf wasn’t a journalist.)

Finally, Saunders tries to smear Wolf with a bait and switch: apparently, this isn’t about an attack on a cop. It’s about an attack on a gay man. Last time, we checked, Wolf did not attack any cops, straight or gay. Nor did he film the attack in question. What he did film was the other officer beating up an anarchist. But who cares about the truth when you’re busy spinning?

The only thing that seems to concern Saunders about Wolf being caged is that it’s costing tax payers dollars. Yeah. Along with trying to turn Wolf into an investigative tool of the government and chill dissent in the process. But who cares about free speech?

So, thanks, Saunders, for reminding us about Wolf. Enjoy the lemonade.

Bush asked congress to approve $622 billion for defense spending, most for the wars in Iraq and Afghanistan, in a $2.9 trillion budget request for 2008, according to Reuters.

Here is a running total of the cost of the Iraq War to the U.S. taxpayer, provided by the National Priorities Project located in Northampton, Massachusetts. The number is based on Congressional appropriations. Niko Matsakis of Boston, MA and Elias Vlanton of Takoma Park, MD originally created the count in 2003 on costofwar.com. After maintaining it on their own for the first year, they gave it to the National Priorities Project to contribute to their ongoing educational efforts.

TRASH TV This review of E!’s The Girls Next Door started with a vision of me à la Gloria Steinem for her 1963 Bunny Club exposé, only I was doing my research sitting on my boyfriend’s couch and eating Pirate’s Booty, sans notebook. I grew up in an überfeminist house (No Three’s Company!), spent a semester writing a paper on the sexism in Pretty Woman, and went to a once-all-women’s college that had an unwritten rule about using womyn in all campus postings. So I was mentally going to note The Girls Next Door‘s sexism, infantilism, and misplaced values. Then came the eye-popping bobble-head opening and the catchy "Come on, come on to myyyyy house" theme song promising candy — and candy I got in the form of bottle blonds Holly Madison, Kendra Wilkinson, and Bridget Marquardt (Bridg, to me).

The girls of Hugh Hefner’s reality TV series weren’t the dumb bimbos I’d envisioned — OK, Kendra didn’t know polygamy is illegal in this country and deemed Olive Garden the best. They have career aspirations: Babies! Broadcast journalism! Playmate of the Year! Who couldn’t relate to jealous Holly (Hef’s official number one girlfriend) when his ex Barbi Benton sashays into the mansion and declares, "Hef still has my bust!" to her bronze likeness? Who wouldn’t ooze with sympathy when brainy Bridg has to miss the nude shower shoot because her mean old prof refuses to postpone her semester final? And she studied!

It took only an episode for me to realize I wanted to leave behind my hardworking p.c. life and monogamous relationship and live in the Playboy Mansion. I want to order fried chicken and ice cream from the butler; watch movies with my two BFFs and boyfriend, all snuggled in a California King; and slip and slide down the mansion lawns in a red, white, and blue bikini. I want a murder-mystery birthday party and girls who watch my back when the psychic who claimed to connect with the spirit I saw in my bedroom turns out to be a fraud. I want backyard barbecues and luaus and as many puppies as my heart desires. Puffin — as Holly affectionately calls Hef — hasn’t called yet, but the good news is that with such episodes as "Mutiny on the Booty," "Clue-less," and "Eighty is the New Forty" under my belt, that doctoral thesis is practically writing itself! HELLA, POP LEVI, AND MACROMATICS


In Northern California we are all familiar with the term hella, typically used to convey abundance. This same definition can be applied to Sacramento’s math rock savants Hella, whose chaotic brew of avant musical equations can be compared to a piano falling down an elevator shaft or the sonic vibrations of a song trapped in a quasar. Once made up solely of guitarist Spenser Seim and drummer Zach Hill, Hella has since morphed into a full band with the addition of guitarist Josh Hill, bassist Carson McWhirter, and vocalist Aaron Ross, making for a more contained noise that verges on the fringes of prog. Opening is London’s Pop Levi, who describes his slithering psych pop as "Prince making out with Bob Dylan in Syd Barrett’s bedroom," and Romy Hoffman, better known as Macromatics, who makes punk-rooted hip-hop and has been known to shout out to Lemony Snicket and Melanie Griffith in the same breath. Sure, I remember the first time I heard Josh Ritter, who plays a solo acoustic set as part of Noise Pop. There I was, driving beneath a huddle of midnight pines in the middle of nowhere when a warm drawl lured me off the dirt road and into the airwaves with tales of Patsy Cline’s ghost and girls with wooden-nickel smiles — all delivered with the urgency of a young Bob Dylan and the intimacy of Townes van Zandt. Five years later, the Idaho-bred indie folkie still slays me with the Americana mythology of "Golden Age of Radio," and the storytelling voodoo he has cast ever since makes me wish they’d start giving out the O. Henry Award for songwriting. Ritter could be the first winner. (Todd Lavoie)

On "Dead Plane," a song featured on the band’s MySpace page, a slow burner of dainty hums builds then takes a backseat to a three-chord commotion of dismantled sounds. The gears of this much-blogged-about sextet’s musical engine are greased with an all-engaging medley of brash experimental pop and electronic folk. And like kindred spirits Clap Your Hands Say Yeah and Arcade Fire, the Annuals back up their buzz with a punch of indie rock delight: their 2006 full-length, Big He Me (Ace Fu), has scored a favorable reception from critics and fans alike. Led by singer-songwriter Adam Baker, the Raleigh, N.C., group’s captivating live show promises to be one of the highlights of Noise Pop. AUTOLUX


A dreamlike fusion of languid atmospherics and apocalyptic noise, Autolux’s futuristic dark pop is fit for a fembot. The LA trio is composed of bassist Eugene Goreshter, guitarist Greg Edwards, and drummer Carla Azar, whose pounding percussion echoes with an ominous clamor. On songs such as "Turnstile Blues," from Future Perfect (DMZ/Epic, 2004), austere vocals, lush musical landscapes, and fuzzed-out, droning guitars inspire comparisons to the shoegaze of My Bloody Valentine, the moodiness of Slowdive, and the artful dissonance of Sonic Youth. Their sound may borrow from distortion-heavy bands of the past, but Autolux appear to be ushering in their own version of sonic modernism. (Kaufman)

DANDY WARHOLS


The Dandy Warhols: you either hate to love them or love to hate them. But regardless of their arrogant pomp, overt cheekiness, and swaggering vocalist Courtney Taylor-Taylor’s pretentious double-hyphenated name, this foursome still comes through with catchy, pop-laced psychedelia that successfully blurs the boundaries between the underground and the mainstream. The Dandys — who made a splash with their 1997 single "Not If You Were the Last Junkie on Earth" and later garnered attention as the sell-out antagonists to the Brian Jonestown Massacre’s incorrigible madcap Anton Newcombe in the 2004 documentary DiG! — continue to find commercial success while staying true to their original sound. This show’s openers include the Bay’s Elephone and Oakland’s Audrye Sessions, whose sweeping, romantic indie rock lullabies will thaw even the most jaded heart. (Kaufman)

ALELA DIANE


What hath Vashti wrought? Here they come round the mountain, like Melissa Gilbert as Laura Ingalls Wilder in the credit sequence for Little House on the Prairie — yes, indeedy, the fair maidens with granny hankies of acoustic stringed Americana seem to be multiplying endlessly or cloning themselves through antique alchemical methods such as MySpace. Yet many deliver the goods — and I don’t just mean personally sewn CD packaging; I mean singing and songwriting. Such is definitely the case with the palindromically named Alela Diane, who hails from Joanna Newsom country — Nevada City — but favors guitar over harp and resuscitates Karen Dalton’s quaver with less affectation than Newsom. Humming through teeth, tying tongues in knots, and finding flatlands within mouths, Diane has a definite flair for oral imagery and aural spells: "My Brambles" vividly invokes a favorite word or pet cat, while "The Rifle" and "Lady Divine" flirt with danger instead of falling prey to it à la Marissa Nadler’s eerie murder ballads. (Diane’s handsome friend Rubio Falcor also has a way with a song, if his MySpace cabin is anything to go by.) Along with Zach Rogue and Thao Nguyen, Diane will open for Vic Chesnutt, who is dusting off his shelves and ghetto bells for a few California shows. (Johnny Ray Huston)

DEAD MEADOW


Followed by a trail of critical acclaim inundated with joint-smoking references and marijuana puns, Dead Meadow are frequently and unfairly categorized as drugged-induced hard rock. Instead the Washington, DC, group possesses a genius far surpassing the clownish gimmickry of unsophisticated stoner jams. As musically intricate and ethereal as they are untamable and beastly, Dead Meadow take inspiration from rock greats such as Jimi Hendrix, Black Sabbath, and Led Zeppelin but inhabit a unique and mystical domain where early incarnations of metal coexist with swirling, murky psychedelia — the perfect soundtrack for a druid ritual or black magic spell casting. PONYS


Chicago’s Ponys are making dangerous music. You know, the kind of stuff you don’t want your little sister listening to for fear that she might become seduced by the unduutf8g rhythms, or worse, that she’d fall for the shaggy-haired drummer. This tough-as-nails garage quartet is the sonic kick in the pants that music fans have been craving. Saddled with thundering guitars and ferocious bass lines, the Ponys bring grit and musical malevolence to a famously frenetic live show. Even better, Jered Gummere’s sneering vocals evoke Richard Hell’s, lending an old-school flavor to a feral yet infectious racket composed of equal parts DIY primordial punk, dirty psych à la Blue Cheer, and Love’s irreverent melodicism. SPINTO BAND


If you own a television, you might already know the Spinto Band — or at least their song "Oh Mandy," which provided the soundtrack to a Sears commercial. But don’t hold that against this quirky, energetic group from Delaware. While you’re dancing to their melodic, happy, and bouncy brand of indie rock, you’ll forget all about sweaters and washing machines. Also on the lineup: Dios Malos, who offer catchy and experimental SoCal suburban indie pop; the Changes, who make romantic, earnest pop that made them one of Paste‘s bands to watch; and the Old-Fashioned Way, who produce danceable indie with a sense of humor straight outta the Tenderloin. When last we looked in on Aqua, the prospect seemed rather marbly and banklike, and the menu included paella. Paella is not a dish you should order even at most Spanish restaurants, let alone at a high-end seafood house, but a member of my party went ahead and ordered it anyway — in the heedlessness of youth — and was afterwards disappointed. "What did you expect?" I asked, from the unassailable position of someone who’d opted for Pacific swordfish grilled in a sheath of prosciutto, the sort of dish you’d expect to find, and enjoy, at a place like Aqua. "I don’t know," was the glum rejoinder.

Years passed, youth faded, and we did not return. The meteoric George Morrone, who’d been in the kitchen when Aqua opened in 1991 and was the chef during our visit — which is what tells me it was in ’91 or ’92 — gave way after a few years to Michael Mina, who ran the show for more than a decade until he left to open his eponymous Union Square restaurant in 2004. His successor was Laurent Manrique, he of the recent foie gras kerfuffle. Manrique does offer foie gras on his Aqua menu, but the offer is a muted one: there is no foie gras cart plying the dining room (whose look, incidentally, seems to have been softened to tones of a summer twilight). There had been such a cart at Campton Place, Manrique’s previous gig. When the foie gras cart and the cheese cart were simultaneously at large in that rather snug dining room, one had a brief vision of dandified bumper cars.

You (which is to say, I) would not necessarily expect a chef renowned for his treatments of foie gras to be the ideal head of a kitchen largely devoted to the cooking of seafood. And yet if this is a paradox, it is a spectacularly successful one; for much (and maybe most) seafood needs a certain amount of dressing up to show well, and at Aqua, Manrique’s instinct for meatiness results in plates of fish neatly balanced between elegance and muscularity.

Part of the Manrique magic has to do with bold spicing. Ahi tuna tartare, for instance, has become something of a commonplace in the past decade. The fish’s reddish purple flesh looks a lot like beef and has its own sort of intensity. But the dish becomes special at Aqua when the cubes are mixed with Moroccan spices (these weren’t specified but had a currylike aura) and a quail egg yolk as a binding agent. (Aqua’s à la carte menu is, like the paella, a thing of the past; today you choose three courses for $72 or a more elaborate tasting menu, with optional wine pairings, for $109.) Across the table, meanwhile, a plate of albacore carpaccio — tissue-thin bolts of flesh looking almost like ice shavings — arrived under a colorful bloom of Fresno chile rings, slivers of daikon radish, and bits of fried shallot: springtime on the tundra.

A whiff of curry subtly recurred in the buttery chardonnay jus our server poured around a grilled filet of walu, one of those marvelously meaty white fish from the deep waters around the Hawaiian Islands. The fish wore a straw hat of pommes alumettes (crispy filaments of potato), while a few quartered baby artichokes lurked at the bottom of the plate. Even meatier was sturgeon, cooked en papillote (in a paper bag) and presented as three cylinders — a kind of faux roulade hedged with braised baby spinach and finished with a rich duck jus, also poured by the server from a small pitcher.

Even if you confine yourself to the more modest prix fixe — and we found three courses to be just the right amount of food — you will be given a few extra treats. There are the warm breads — olive, sourdough, multigrain — in constant circulation through the dining room. There is the amuse-bouche, for us a tripartite presentation on a handsome rack: a lemon oil–slicked sliver of Monterey Bay sardine on celery coins, a profound wild-mushroom soup capped with gratinlike pine-nut pesto, and a smoked-ahi croquette with a perfect and crispy golden crust, despite its fingernail size. And there are the postprandial petits fours, tiny tarts, macaroons, and meringues (including a purplish gray one of taro root) that reach the table as a final bit of punctuation (not counting the bill, of course), at the end of dessert.

You could, if you wanted, dispense with dessert and just double-dip from the list of first courses. But if you do need a sweet fix beyond and before the petits fours, Aqua’s choices won’t disappoint. For the most part they don’t sound spectacular, nor do they have much to do with the restaurant’s aqueous theme. But they are exemplars of their kind, among them the chocolate tart, like a round of bittersweet fudge nested in a butter crust and ringed by a salad of blood orange and mandarin segments, and the Meyer lemon soufflé, lanced with a spoonful of pomegranate seeds and redolent of the citrus’s unmistakable orangey acidity.

I was saddened to find both Maine skate and Atlantic cod on the menu. The latter, in particular, is a decimated species, as the British journalist Charles Clover indicated recently in his book The End of the Line; surely there is something comparable to be had from the better-managed and far nearer Pacific fisheries. For all the hullabaloo about Manrique and his beloved foie gras, no one has suggested that duck and geese are in danger of extinction. But he and Aqua, given their international stature, have a special role to play in ensuring that today’s seafood houses will have seafood to serve tomorrow. *

With President George W. Bush proposing to push the price tag for the Iraq War up to nearly $600 billion — more than was spent on the Vietnam War — while seeking new cuts in our health care safety net, it would appear the debate over guns and butter is over. The guns have won.

Polls before the last election found that the two issues foremost in voters’ minds were the war and our ever-worsening health care crisis. More than ever, the two issues seem linked. With record budget deficits, substantially inflated by spending on the war, resources for health care and other critical domestic needs are increasingly starved.

On the same day the president was proposing another $245 billion to prosecute the war this year and next, which would bring the five-year total since the war began to a staggering sum of $589 billion, he also called for slashing $78.6 billion from Medicare and Medicaid over the next five years.

In addition, Bush wants Medicare recipients to pay higher premiums for prescription drugs and doctors’ services and is proposing to eliminate annual indexing of income thresholds, effectively another $10 billion in cuts.

Expanding children’s and preventive health programs and addressing "personal responsibility" by tackling childhood and adult obesity are supposedly atop everyone’s short list of health care priorities. But these now appear to be collateral damage.

Bush is seeking a $223 million reduction in spending for the Children’s Health Insurance Program and the elimination of a preventive health services block-grant program, $99 million a year to the states, used for obesity prevention and programs for chronic health conditions.

He’s also seeking millions in reductions for the National Cancer Institute, at the very moment some progress has been made in fighting cancer, and the Centers for Disease Control and Prevention for disease surveillance monitoring of bird flu and other approaching epidemics.

That’s just the cuts. There’s no mention of additional funding to address the national blight of 47 million uninsured Americans, another 17 million underinsured, the increased closure of public hospitals and clinics, including in half of the nation’s poor counties that no longer have a health center, and all the other dismal statistics that have dropped our country to 37th in the world in health care indicators.

Imagine for a moment how else we could have spent $589 billion.

With those same dollars you could buy health insurance for all the nation’s uninsured people for the next three years. Or you could fund the current federal program of spending on HIV/AIDS antiretroviral drugs for the next 60 years. Or you could cover the cost of educating an additional 39.2 million registered nurses.

And while there’s plenty of money to send more troops into harm’s way, veterans are feeling the pain of cuts in our nation’s health spending. According to the Department of Veterans Affairs, 263,257 veterans were denied enrollment for Veterans Benefits Administration health coverage in 2005. To cut costs, enrollment has been suspended for those deemed not to have service-related injuries or illnesses.

"A nation that continues year after year to spend more money on military defense than on programs of social uplift is approaching spiritual doom," Dr. Martin Luther King said. And, he might well have added, endangering the health security of its citizens at home. *

Will rising seas destroy San Francisco’s sewers? Should condos South of Market be on stilts? Could the huge Coca-Cola bottle at the Giants’ ballpark one day bubble with seawater? Can anyone explain why San Francisco still doesn’t have flood insurance?

As temperatures rise, snow packs vanish, and sea levels surge, San Francisco is waking up to its own inconvenient truth: surrounded on three sides by water, paved with concrete throughout, and erecting condo towers faster than you can say "bamboo," the city by the bay is particularly vulnerable to climate change.

With a recent California Climate Change Center report predicting sea levels will rise between four inches and three feet by 2100, San Francisco can expect increased flooding and damage to vital infrastructure and the destruction of fragile ecosystems and low-lying neighborhoods.

The evidence of impending doom is already there.

Addressing a climate change summit last month, Tom Franza, assistant general manager of the San Francisco Public Utilities Commission, revealed that seawater already tops the city’s weirs for about an hour during very high tides. Franza expects this salt water intrusion, which threatens to kill helpful microbes that digest our solid waste, to get worse as sea levels continue to rise.

So what steps is the city taking to combat climate change?

The SFPUC is already building safety valves on floodgates and pushing for environmentally friendly development toward a future where green roofs, grassy swales, and permeable sidewalks will help stop rainwater from inundating already stressed sewers. It’s also working with the Departments of Planning and Public Works to map blocks and lots that are already sinking — known officially as subsidence — and therefore especially vulnerable to flooding from rising seas.

It comes as a shock to learn that the Planning Department doesn’t already have maps of areas that are prone to floods, but zoning administrator Larry Badiner told the Guardian, "In the past, floods were related to free-running streams, and since there aren’t any in San Francisco anymore, it wasn’t an issue."

Senior planner Craig Nikitas did confirm for us that city planners are working with the SFPUC and the DPW to flag blocks and lots prone to sinking, a phenomenon associated with rising seas that city officials don’t quite understand.

"If I had to guess, I’d say [they’re sinking] because most are on sandy soils or fill and over time there’s been a settling of sand or because of subterranean flooding," Nikitas said.

As the city’s subsidence map shows, the problem is biggest in SoMa and along the bay — where concrete-intense development is on the rise.

In the future, Nikitas told us, "If a developer comes in to do something in those areas, the system will flag it, and builders should pay extra attention to drainage and elevation, using raised entrances three steps up from the street and trench drains and installing sump pumps if there’s a subterranean garage."

As small a step as subsidence mapping sounds, it’s a sea change for city planners. SFPUC principal engineer Jon Loiacono recalls how in the past he was trained to say, "If flooding happens on your property, it’s your problem."

Loiacono remembers only one instance when the SFPUC built a pump station in response to a developer’s concerns. That was almost a decade ago.

Advising developers about the perils of building in flood-prone areas sounds obvious, but with that step comes responsibility that threatens to drown the city fiscally. Asked who’ll pay for flood damage, Loiacono pointed to the Federal Emergency Management Agency.

"FEMA is currently mapping San Francisco, but the city would have to join FEMA’s flood insurance program to get coverage," Loiacono said.

Surprised that the city doesn’t already belong, the Guardian called FEMA’s Oakland-based spokesperson, Frank Mansell, who revealed San Francisco is the only city in the Bay Area that isn’t part of FEMA’s National Flood Insurance Program (NFIP). Participating in the FEMA mapping program would allow residents to qualify for federally subsidized flood insurance and get rebuilding grants after a disaster. FEMA’s Henry Chau says San Francisco will have to raise its standards "slightly higher" to join the agency’s flood insurance program.

Noting that FEMA’s San Francisco map is due this summer and includes development that lies in the city’s floodplains — development FEMA strongly discourages — Mansell said he doesn’t know why San Francisco doesn’t belong. But he does know cities that do must build to code and enact ordinances to ensure people aren’t living in flood zones. He said cities that do build in flood zones must take preventive steps such as raising buildings.

"If cities don’t comply with FEMA’s requirements, they’re put on notice and could be removed from the flood insurance program," Mansell said, adding that disasters such as Hurricane Katrina illustrate why private brokers won’t sell flood insurance.

But as FEMA digitizes and puts its maps online and predicts that 92 percent of US residents will belong to the NFIP by 2010, not everyone is singing its praises. San Francisco Bay Conservation and Development Commission executive director Will Travis faults FEMA’s flood maps for not factoring in climate change.

"Instead, FEMA looks to the past to determine floodplains. As a result, their maps are inadequate and show less inundation than is already occurring," Travis told us. The BCDC just released maps that show a two-meter sea level rise in the bay that would put the San Francisco and Oakland airports and the Giants stadium underwater.

"But we won’t allow the Giants’ ballpark to flood, SFO to be underwater, and San Francisco to become Venice," Travis said. "Instead, sea walls and levees will be built. It’ll require more investment in infrastructure and shoreline protections. The point of the maps is to show people what could happen and get them to take action. Sea level rise doesn’t belong in the realms of science fiction. It’s happening now."

With the California Climate Change Center reporting a seven-inch rise in the bay since 1900 — and the feds refusing to address the role of carbon emissions in climate change — Travis predicted that insurance companies will have the biggest impact in land use planning.

"There’s always an effort to shift costs from the private to the public sector, and from there, from the local to the state to the federal government," Travis told us. "But insurance companies are looking at potential huge losses and won’t be offering policies at all, or offering them at very high prices."

Mansell defended FEMA’s flood maps, arguing that they’re used primarily for insurance and so can’t be used for forecasting.

"We look at existing data," Mansell said. "Otherwise everyone’s premiums would be unpredictable and probably high. FEMA does encourage communities to build to the highest standard, which means the 100-year flood event that has a 1 percent chance of occurring. And FEMA doesn’t conduct the studies. The Army Corps of Engineers does."

Army Corps spokesperson Maria Or confirmed that her agency collects data at different times of the year — data showing the climate has been changing and helping forecast what those changes will mean.

"But we can’t base maps on pure speculation," Or told us. "We continuously look at new data and reanalyze the situation based on that new information. The more relevant question is how often a FEMA map is updated."

Mansell said it takes FEMA one to two years to create a flood map, using computer models, precipitation and tidal patterns, rivers and stream flows — and tracking how much concrete is laid down in an area and how much is built in a floodplain.

"Areas are mapped and remapped and show three levels of risk — low, moderate, and high risk," he said. Based on these ratings, FEMA reviews flood insurance premiums once a year.

But with FEMA the main hope of covering sea rise–related flood damage, experts such as Dr. Peter Gleick of the Oakland-based Pacific Research Institute join the BCDC’s Travis in accusing FEMA of having "failed miserably in integrating climate change into its planning."

"BCDC included climate change in their maps. FEMA did not. Why aren’t there flood maps everywhere around the country that integrate climate change?" asked Gleick, who produced a map 17 years ago showing the impact of a one-meter sea level rise on the bay.

"It’s a little depressing to have been working for two decades on this," Gleick conceded. "I’m glad people are starting to pay more attention and accept that sea level is going up, because the impacts will depend on how we react and how quickly, but we’re decades too late to prevent bad things from happening."

Outraged by President George W. Bush’s we-can’t-afford-to-unilaterally-cut-greenhouse-gases argument, Gleick said, "They’re putting short-term economic gain ahead of long-term survival." But he praised California for establishing a cap to reduce the state’s greenhouse gas emissions to 1990 levels by 2020.

In light of an Intergovernmental Panel on Climate Change report that suggests a 10- to 20-foot sea level increase in the next 1,000 years, Gleick observed, "That means hundreds and millions of people will be potential refugees. So we better reduce our greenhouse gases starting now. We can’t prevent some change, but we hope to prevent disastrous sea level change."

Gleick said he’s worried that we won’t protect low-income areas or move fast enough to prevent damage, a shortcoming that will also have devastating environmental impacts.

"Marshes and wetlands have no place to retreat, since the areas around them are already built up," he explained. "Bay Area communities should make parks, bay and coastal trails, and wetlands bigger, so they’ll have greater protection 50 years from now. And if you’re developing a building that’s supposed to last for 50 years, you need to design it now for the changes that are to come." *

From hardcore to soft

What happens when you can fit your entire tour into a pickup truck? When your song can follow a Neil Young track in a juke joint? When you’re able to blend your steel guitar with indie rock unironically? What happens when you stop playing loud and start getting real?

Things get really, really good.

Could this be the culmination of what was intended when Armchair Martian guitarist-vocalist Jon Snodgrass and All frontperson Chad Price decided to unplug their amps and form Drag the River? Now — a decade after these hardcore dudes decided to play it slow, low, and rootsy — we’re left wondering how anyone else can lay claim to the most whiskey-soaked of genres, country rock. Staking thematic ground between Bruce Springsteen and the Minutemen, their sixth album, It’s Crazy (Suburban Home, 2006), builds icons from the shells of the down-and-out, romanticizes the working class, and casually explores Americana motifs. It’s Crazy‘s strained, simple "Mr. Crews" pulls us through the tough times of the wayward misanthrope: "Words are hard and bulletproof. Are we monsters? Are we fools? Rednecks, rejects, lonely losers …" "Leavin’ in the Morning" is a sparse charge through failed romance, and "Beautiful and Damned" covers the heart-wrenchingly hopeless category, while "Amazing G." gives an anthemic nod to the misguided barroom girls of the world. "Well, she once believed in Jesus," Price sings, "but she never believed in love. Now she worships at the altar of alcohol." And with a swollen sway, "Dirty Lips" fetishizes the hard-worn woman: "You must be talking too much shit — someone’s gonna smash your pretty lips."

Fan favorite "Me and Joe Drove Out to California" is straight stadium country — the kind that makes you want to drive and drive and drive — and in this, Drag the River electrify the essence of the best country songs, crossing state lines, raising hell, and chasing down your own good times.

Track 13 is so much more than just a title track: it’s a welcome reprise of the entire album and a reminder that this is not kitsch country — this is the hard stuff. In fact, one might have difficulty pegging Drag the River as alt-country if not for the past musical affiliations of its members. Shedding pretense and skin, Drag the River provide their brittle bones for our consideration and show us what veteran punk rockers are capable of. (K. Tighe)

Bush’s big favor to PG&E

EDITORIAL If there were ever any doubt about the political forces arrayed behind the move to demolish San Francisco’s Hetch Hetchy dam, this should put it to rest: President George W. Bush, who has done nothing but attack, undermine, and cut funding for public parks and environmental initiatives since the day he took office, suddenly wants to spend $7 million to study restoring the valley behind the dam.

That’s right. Tucked into the Bush administration’s Department of the Interior budget is a special allocation that just happens to match exactly what the state of California said it would cost for the next step in pursing dam removal in Yosemite National Park.

Initial signs are that the plan isn’t going anywhere: Sen. Dianne Feinstein, who chairs the Senate subcommittee that funds Interior, says she’ll never let the money go through. Even Republican Rep. George Radanovich, who represents the Yosemite area in Congress, says he opposes the idea and has no idea why the administration is pushing it.

Well, we have a clue.

Bush isn’t much of an environmentalist, and it’s hard to believe he really cares about creating a new wilderness area in California. But he’s a hell of a privatizer and supports almost anything that shifts public resources into the hands of profit-making companies. And blasting the city’s water and hydropower dam to dust would be a huge favor to one of the nation’s largest private electric companies — and a huge blow to public power efforts in San Francisco.

Feinstein points out — correctly — that the dam provides fresh water to almost three million people in the Bay Area. But it also provides electric power — not enough to light all of San Francisco, but enough to provide a nice solid base for a municipally owned electricity system. In fact, the dam itself is the biggest argument for kicking Pacific Gas and Electric Co. out of town: the act of Congress that allowed San Francisco to dam Hetch Hetchy Valley for water also mandated that the dam generate electricity and that this cheap power be sold to the residents and businesses of the city as a public alternative to the PG&E monopoly.

PG&E is terrified by the prospect of losing a single customer to public power and for good reason: electricity controlled by public agencies is consistently cheaper and, these days, more environmentally sound than the stuff you buy from PG&E. Up in Yolo County, businesses recently realized they were paying more money for power than their colleagues (and competitors) a few miles away in Sacramento, so they moved to join the Sacramento Municipal Utility District. PG&E spent more than $10 million on a campaign to defeat the proposal — and that area involved only 77,000 customers. Imagine what the company would be willing to do to halt the growing calls for public power in San Francisco, a market roughly five times that size.

It’s no coincidence the company is pouring cash into a public-relations campaign aimed at burnishing its environmental image. And as we report in "PG&E’s Poll" on page 10, pollsters apparently working for PG&E have been market-testing several ballot initiatives that would directly attack the city’s ability to go into the power business.

But tearing down the dam would be a far more effective assault. Without the dam the federal mandate for public power would vanish, as would a free (we paid for it long ago), reliable, copious source of renewable electricity that uses no fossil fuels.

Sure, there’s an environmental argument for tearing down the dam — as soon as those 400 megawatts of electricity can be replaced by city-owned solar, wind, or tidal power. But that’s years off. For now the alternative to hydro is largely fossil fuels, which makes the green case for removing the dam shaky at best.

So let’s be serious here: This is not about environmental restoration. It’s about keeping San Francisco out of the power business and preserving PG&E’s private monopoly. That’s so perfectly in line with the Bush administration’s political philosophy that we’d be stunned if PG&E and its allies weren’t the ones who got that $7 million allocation snuck into the Bush budget.

All of which is, of course, an excellent reason for Congress to scrap this budget item, and it appears that will happen. But it’s also reason for public power advocates to go on full alert: PG&E isn’t sitting back and waiting for the next municipalization campaign. The company is making its own plans to cut public power off at the knees — and that means the progressives need to be mobilizing for a full-court press on the issue. Now. *

Guardian contributor Max Goldberg pointed to this sad news announcement on Pitchfork on the death of Cayce Lindner of Oakland band Flying Canyon:

“Cayce Lindner, frontman for self-described “California doom folk” band Flying Canyon, took his own life yesterday, Feb. 6. No further details are available regarding his death, nor do we know how old he was.

“Lindner, who lived in the Bay Area, was in the bands the Golden Hotel and the Goodwill Tapes before forming Flying Canyon with the Jewelled Antler collective’s Glenn Donaldson and Shayde Sartin. He was also a filmmaker.

“Sidney Alexis Lindner, Cayce’s brother, fronts the Portsmouth, New Hampshire band the Hotel Alexis. He was also in Golden Hotel with Cayce.

“Last fall, Soft Abuse released Flying Canyon’s enchanting self-titled debut album. Our own Brandon Stosuy wrote, ‘Lindner and friends carve out an erudite haze that foregoes caricature and wardrobe changes in favor of melody, inventive instrumentation, strong songwriting, and an honest, riveting charisma.’

Soft Abuse’s Chris Berry said, ‘We are deeply saddened and we’re thinking of his friends and family.'”

Goldberg himself e-mailed: “I’d only actually seen the band play once (opening for Peter Walker at the 21 Grand), but just found out they were set to play at this show my housemate Dave is setting up in a couple of weeks in the Marin Headlands….”

Previously our man Max had praised the band, which consisted of various Skygreen Leopards: “The frontman’s gruff, hard-drivin’ hippie style is a welcome antidote to some of the more whimsical manifestations of psych folk.”

Robert Pinsky

Don’t try to tell Robert Pinsky poetry doesn’t matter. The former poet laureate has worked tirelessly to convey poetry’s importance in a way that transcends the esoteric. Beyond writing his own poems and essays, Pinsky has applied himself as a teacher, speaker, and translator. San Francisco historian, activist, and cyclist Chris Carlsson explores San Francisco’s labor history in his lecture “What Ever Happened to the Eight-Hour Day?,” sponsored by the SF Museum and Historical Society.
