Marriage equality showdown, on the streets and in court

The scene at Civic Center Plaza today showed that the culture wars are still raging in the United States, with same-sex marriage arousing strong feelings on both sides of the debate. But it’s a clash that the California Supreme Court could largely end if it sides with San Francisco and finds that same-sex marriage rights aren’t subject to majority will.
That ruling isn’t expected for several months. While there was no clear sign during today’s oral arguments whether the court would uphold Proposition 8, swing vote Justice Joyce Kennard did seem to be leaning toward letting the measure stand, emphasizing that changing the constitution (in this case, to remove same-sex marriage rights) is “a basic right, a fundamental right” and how “this case is different from last year’s case,” when she found the ban on same-sex marriage to be unconstitutional.
But San Francisco Deputy City Attorney Therese Stewart engaged with Kennard for a long time, arguing that constitutional protections of minority rights are worthless if they can be simply voted away at the ballot box. As she said outside the courtroom after the three-hour hearing, “We hope the court will not sell our constitution down the river.”

Retired Chronicle pressmen suspect Hearst

Chronicle employees have remained silent about Hearst Corp.’s claims that it needs to make major cuts now, or it will sell or shutter the paper. Their silence is understandable: folks everywhere are afraid of losing their jobs in a major recession. And, as the California Media Workers Guild reports, talks with Chronicle management representatives continue, focusing on management’s latest response to the Guild’s proposals to minimize job losses through cost cuts and business-recovery initiatives.

The Guild previously reported that their negotiators had offered Chronicle management representatives, “a comprehensive package of proposals to cut costs, minimize layoffs, generate new revenues and speed the transition from newsprint to online communications,” but Chronicle management expressed doubts about whether the would be enough to avert deep job losses in the Guild’s ranks.

But while Chronicle workers remain mum, and Chronicle editor-at-large Phil Bronstein tries to take credit for this crisis, Denis Mosgofian, a past president of Local 4, which has represented pressmen in the Bay Area for 110 years, has shared his theory about what just happened.

Mosgofian, who has been in the printing trade since 1972 and with the Chronicle since 1987 until he retired in 2001, believes Hearst may be overstating just how bad its finances really are. He also doubts whether Hearst is sharing its books with the Chronicle in a way that would help the newspaper evaluate Hearst’s claims. Here’s what he said:

“The Hearst Corporation announced early last week that they would either get concessions from the unions at the San Francisco Chronicle and be able to cut costs or the Hearst Corporation would seek a buyer or shut the paper down.”

“This announcement comes at the midst of the recession/depression. It comes after the Chronicle has already shut down its Richmond and San Francisco production operations and just four months before closing its very large Union City production plant and outsourcing its production to a Canadian non-union printing company named Transcontinental, which has built a brand new production plant in Fremont, California, scheduled to begin production of the Chronicle on June 29, 2009.”

CHEAP EATS I love how, on the train, you can see into people’s backyards. Backyards are so much more interesting to me than front ones. What you don’t see from the road … it’s the same in California as Iowa as Pennsylvania: piles of colorful plastic trash, tarp-covered mounds of mysterious not-yet-trash, broken-down swimming pools with bikes sticking out of them, neurotic dogs and malicious children tied to trees …

Sometimes, just outside of cities, between the tracks and the freeway, you see tent towns or hobo jungles, cluttered camps tucked into clusters of trees or just trying to hide in weeds and bushes. Sometimes there is smoke billowing up from a fire pit and you are free to think about coffee or a can of beans.

But litter is more beautiful than people think, especially blooming in an otherwise pristine "natural" landscape. Although … I would argue that our trash is natural too, that Coke cans and candy wrappers are to rocks and leaves what Miles Davis is to wind and rain. We make stuff that outlives us, get over it. Or not. Either way, detritus makes me want to dance.

What I don’t like about train travel, on the other hand, is the museum piece doofus who gets on in Sacramento and blabs about the Donner Party and this scenery and that history, PA system crackling, fracturing, and feeding back, all the way to Reno. I tried to drown him out with my headphones but Utah Phillips wasn’t loud enough. But Abba was, thank you for the music.

After Reno it doesn’t matter. You are too rattled and fuzzy to care — about the sunset or canyons, or the Colorado River, or the Great Plains. Of course, without the voice directing you to look at this, look at that, you tend to notice every single thing.

Two nights in a row I dreamed about tornadoes. The first night I was home in bed, and the second night I was on the train. Only thing tying the two nights together was what I’d had for dinner: Zachary’s pizza. So if I dream about tornadoes tonight, after eating Zachary’s yet again, then we will know the cause.

I’ve got a little cooler and am the envy of this choo-choo train, because I’m holding Zachs.

My thinking: nothing packs more caloric and nutritional value per square inch than a slice of deep-dish pizza. One little piece is a whole big meal. Plus pizza is good hot or cold, as every rocker knows, and it travels well. Well, it travels well in a cooler on a train. Not so much so in a pizza box in the rain. I had to walk five or ten blocks in a downpour, trying to hold my little umbrella over both me and this two-ton pizza. We both got soaked, and the toppings slipped off of the pie and my hat fell off of me. But we made it, and reassembled, and dried off, and by the time I get to Chicago I will have eaten Zachary’s for four straight days, and presumably will have dreamed about tornadoes for four straight nights.

But I mean to tell you about Christopher’s burger joint, which is my new favorite burger joint by virtue of being a little closer to my house than Barney’s. The burgers are made out of Niman Marcus designer cows, but the place itself has a lower brow feel to it, which of course I like.

And they have shoestring french fries, which I like.

Just be ready with the salt and pepper and hot sauce, because nothing, not even the spicy burger, was seasoned very much.

I ate there on a date (speaking of flavorlessness) with one of those guys who only really knows how to talk about himself. You know, the one with an hour-long answer to every question you ask, but he doesn’t have one single question for you. While not exactly what I’m looking for, these dates always go well for me, because while he’s talking, I get to focus on my burger. And fries. Which is ultimately what I’m more interested in.

My date said (among 9 million other things) that he’d met the owner of Zachary’s and, ha ha, told him that Zachary’s was the second-best pizza he’d ever had. And when Zachary asked whose he liked better he said his own homemade pizza. Dude makes better pizza than Zachary’s! And I have no reason not to believe him, except that — and this is pretty flimsy as well as retroactive — I did not dream about tornadoes that night.

GREEN CITY Public transit agencies in the Bay Area are being hit with deep cuts to their operating budgets, thanks to the recent state budget deal, and are hoping to use money from the federal economic stimulus bill to maintain their operations.

That conflict played out during a Feb. 25 hearing by the Metropolitan Transportation Commission in Oakland, the agency that distributes federal transportation funds to the nine Bay Area counties, which was considering how to distribute $341 million in funding intended for public transit agencies and $154 million for road projects.

Caltrain, AC Transit, Bay Area Rapid Transit, the San Francisco Municipal Transportation Agency, other Bay Area districts, and transit user groups urged the MTC board to direct most of the money to immediate needs rather than long-term projects.

Community groups urged the MTC to abandon plans to use $70 million for BART’s Oakland Airport extension and $75 million for the Transbay Terminal rebuild in San Francisco.

“People who are most affected when Muni makes fare increases and service cuts are people who are transit-dependent,” said Razzu Engen, who represents the Tenderloin Housing Clinic and the Transit Justice Project. “You can have the best capital expansion project there is out there, but if you don’t have the money to run it, forget it, it’s not worthwhile.”

While the MTC voted to remove the Transbay Terminal expenditure — noting that it could tap into a separate pot of $8 billion for high-speed rail projects in the stimulus measure — they kept the BART extension project in place, leaving $271 million to be divided among the transit agencies.

“Our ongoing need is to maintain continuing operations. But maintenance doesn’t have a very big constituency on the commission. We have a firm commitment to capital programs,” MTC spokesperson Randy Rentschler told the Guardian.

Judson True, spokesperson for the San Francisco Municipal Transportation Agency (which operates Muni), said the money will help offset state funding losses of $61 million over the next two years and allow the agency to “rehabilitate the system.”

Among the expenditures approved by the MTC was $11 million to install 67 new Muni ticket vending machines and money for new Muni vehicles and rail interchanges.

Jose Luis Moscovich, executive director of San Francisco County Transportation Authority, supported the MTC’s decision. “[We’re] going to see money flowing through formulas to Muni to alleviate service conditions on the T-Third, N-Judah, the L.”

Moscovich maintains that the region “needs to take the opportunity of the stimulus package to do things that are going to change the way we live. Paradoxically, these big projects like the Transbay project are the things that are going to take us in that direction.”

Yet the removal of the Transbay Terminal funding, while upsetting to Sup. Chris Daly — who serves on both the MTC board and the Transbay Joint Powers Authority board — turns out to be even more complicated than it seemed at the time.

The San Francisco Chronicle reported March 2 (“Transbay high-speed rail station hits a snag”) that both the California High Speed Rail Authority and Caltrain — systems expected to share the new Transbay Terminal rail terminus — are now expressing doubts about whether they will use the facility after all because of design flaws with its rail component.

CHSRA chair Quentin Kopp was quoted as saying, “Three sets of engineers met and concurred that the design for the station was inadequate and useless for high-speed rail.”

TJPA spokesperson Adam Alberti, who has been sparring with Kopp in recent months over whether Transbay will be the terminus for a high-speed rail system extending from San Francisco to Los Angeles (see “Breaking ground,” 12/10/08), told the Guardian, “I don’t think it’s as bad as it sounds.”

He said the TJPA is currently working to resolve the engineering problems and handle the increased volume expected from high-speed rail and Caltrain and he hopes to have a solution in place by March 12, when he said the MTC will revisit the matter.

BART General Manager Dorothy Dugger also defended the Oakland Airport extension, telling the Guardian, “The challenge in transit is not one over the other. We need to address all those requirements if we’re going to end up with an effective, functioning system that continues to attract people out of their cars and into the smart environmental choice — which is public transit.”

 

Blaming the system

The Grand Sheraton Hotel in downtown Sacramento was buzzing Feb. 24 as some 400 conference-goers representing myriad geographies and political perspectives gathered in one room to tackle an enormous question: should California’s constitution get an overhaul?

Hosted by the Bay Area Council, a San Francisco-based business group, the summit introduced the idea of staging a statewide constitutional convention that would grant Californians the opportunity to make major revisions to the state constitution and streamline the government reform process.

The council hopes to place a measure on the ballot as early as November 2010 to ask voters if a convention should be called. If the effort gets a green light, it would mark the first time in 130 years that a meeting of this kind was convened in California.

The state’s government is dysfunctional, Sacramento Bee columnist Dan Walters opined during the summit. Full of stakeholders with disparate viewpoints who are too often unwilling to collaborate, he said, the Legislature either tends to roll out "unworkable monstrosities" or have its efforts stalled by a small number of representatives who disagree with the majority. "The problem isn’t really which party is in charge," he said. "It’s the fundamental structure of the government."

The summit attracted diverse interests ranging from Chevron Corp., an icon of big business in the Bay Area, to the Courage Campaign, a left-leaning political organization cast in the mold of Moveon.org. Despite being divided on other issues, all parties seemed to be in agreement on the main point that California’s government is desperately in need of a fix.

"I think of the government in California as being like the Winchester House — you keep adding rooms, but there are no corridors," Sen. Mark DeSaulnier (D-Concord) joked at the summit, referring to a historic mansion in San Jose renowned for its monstrous size and complete lack of a floor plan.

The idea for holding a convention was first floated last summer, when Bay Area Council President and CEO Jim Wunderman published an editorial in the San Francisco Chronicle titled "California Government Has Failed Us." Wunderman struck a nerve, and organizations such as Common Cause and the League of Women Voters signed up to partner with the business group to launch the constitutional convention effort. Clamor for government reform got louder still in recent weeks, as a disapproving public witnessed legislators sink into a debacle over the budget deal.

An arduous budget debate further intensified when it came to extracting the last vote needed to achieve the required two-thirds majority. The Democratic majority wound up negotiating with Sen. Abel Maldonado (R-Santa Maria), who turned his vote into leverage to force concessions on his own demands. Maldonado was able to single-handedly eliminate a proposed 12-cent increase on the gas tax, and he stipulated that an initiative be placed on the May ballot for an open primary.

"The budget was held hostage to right-wing ideology when the people of the state were demanding a real solution to a real problem," says Lenny Goldberg, executive director of the California Tax Reform Association and the owner of a lobbying firm. "For example, the only way they could get the votes was to give away huge corporate loopholes."

The lesson learned? "We have tied ourselves in knots with the two-thirds vote requirement," declared Lt. Gov. John Garamendi, a moderate Democrat and gubernatorial candidate, spurring a round of applause at the summit. Garamendi called for "majority rule, plain and simple, on every issue." He also suggested extended term limits, and transitioning to a 120-member unicameral legislature to allow representatives to better represent smaller districts.

Other ideas for reform that got bandied about during the summit included reinventing election procedures and considering approaches such as instant-runoff voting, establishing proportional representation, changing the number of signatures needed to place an initiative on the ballot, and establishing an automatic review process for state agencies.

In order to hold a convention, California voters would have to approve two separate ballot initiatives. The first would create an amendment to the current constitution allowing voters to call the convention, while the second would call the actual convention. Both questions could be put to voters on the same ballot, according to the Bay Area Council. Any changes made to the constitution would then have to be ratified by voters.

The process of calling a convention is clear enough, but questions abound on how to proceed from there. For example, how would convention delegates be selected? How many would attend? How would the organizers ensure inclusiveness across ethnic, gender, and economic boundaries? Would the convention open up the entire constitution to debate, or would parties agree to narrow the scope to a few key issues? How would the convention itself escape the same gridlock that critics say has rendered the Legislature dysfunctional?

Without hammering out the fine points, it’s hard to know whether the enthusiasm exhibited at the summit could survive the nitty-gritty details of actually going through with a convention. It’s also too early to say whether progressives could emerge from such a process satisfied with the results.

Assemblymember Tom Ammiano adopted a wait-and-see attitude toward the constitutional convention. "I wouldn’t tell you at this point I’m enthusiastic about it because it could be too much blah-blah and not enough action," he told the Guardian. "I do definitely support budget reform — I’m going to make that a priority — and really want to look at the budget infrastructure, certainly the two-thirds majority. I think we need to deliberate on it and make certain that it wouldn’t have any unintended consequences."

Sen. Mark Leno shared Ammiano’s view that the two-thirds majority requirement tops the list of problems. "I think we could take some modest but profound steps before we open up an entire potential Pandora’s box," he said of the convention idea. "I don’t wish to dampen the spirits of our friends at the Bay Area Council. Their intentions are very good. But should it go forward, the devil will be in the details."

Goldberg took a similar stance. "The biggest problem is the two-thirds vote requirement for taxes and a budget," he told the Guardian. "If a constitutional convention is the way that issue gets resolved, that’s positive. But the question is, how long is that going to take? How are they going to do it? There are so many unanswered questions that I would say, if that’s the only way to deal with the two-thirds vote, let’s do it."

Robert Cruickshank, public policy director at the Courage Campaign and a blogger with the political Web site Calitics.com, said he feels confident that a convention is a worthwhile pursuit for progressives. His organization conducted a poll of its membership to gauge whether there was progressive support for the idea, he said, and results showed that 92 percent of respondents supported it.

For his part, Wunderman emphasized the convention as a tool that could be used by voters rather than elected officials in Sacramento. "I’m excited about changing the game, changing the rules," he told the Guardian. "And I’m more confident than ever that if you lead Californians to revise their constitution, once they see it, they’ll know what they have to do, and they’ll do it. And the fact that it was them that did it will give rise to support for the product."

The Chronicle death watch

Is San Francisco really the frontrunner in the race to become the first major U.S. city to go without a major daily? Or is it a victim of disaster capitalism, in which powerful corporations exploit economic meltdowns to exact otherwise unacceptable concessions from employees and/or antitrust legislators?

Media critics chewed on those questions last week, following Hearst Corporation’s abrupt Feb. 24 announcement that it is undertaking "critical cost-saving measures including a significant reduction in the number of its unionized and non-unionized employees" at the San Francisco Chronicle, and will close or sell the paper, which has 1,500 employees, 275 in the newsroom, unless these changes occur within weeks.

Noting that the Chronicle lost more than $50 million in 2008 — the worst in a string of nonstop losses the paper has suffered since Hearst bought it in 2000 — Hearst vice chairman and chief executive officer Frank A. Bennack Jr. and Hearst Newspapers president Steven R. Swartz warned that "without the specific changes we are seeking across the entire Chronicle organization, we will have no choice but to quickly seek a buyer for the Chronicle or, should a buyer not be found, to shut the newspaper down."

Two days later, the California Media Workers Guild, which represents workers at the Chronicle, reported that Hearst is seeking "a combination of wide-ranging contractual concessions in addition to layoffs, the exact number of which the company said it did not yet have."

"For Guild-covered positions, the company did say the job cuts would at least number 50," read a Guild statement. "Other proposals include removal of some advertising sales people from Guild coverage and protection, the right to outsource — specifically mentioning ad production — voluntary buyouts, layoffs and wage freezes."

Guild representative Carl Hall said he doesn’t see any reason to think Hearst’s threats are a bluff.

"The Rocky Mountain News just closed in Denver," Hall told the Guardian. "The Seattle Post-Intelligencer, which is also owned by Hearst, is slated to close in March, if a buyer isn’t found. We’ve seen bankruptcies and disaster scenarios all around the country, and the Chronicle has experienced some of the deepest operating losses in the nation."

Reached for comment March 2, Chronicle publisher Frank Vega told the Guardian, "We’re still in the process," while Guild treasurer George Powell said that "proposals have been exchanged and each side is evaluating them."

WHERE’S THE MONEY?


Evaluating Hearst claims is hardly an easy task. A privately held corporation, Hearst doesn’t open its books to the public. But one thing is clear, just from reading postings on the corporation’s Web site: Hearst is midway through a squeeze in which it’s trying to turn a profit on the 15 newspapers it owns throughout the country.

And that means more syndicated stories — and possibly the end of free newspaper Web sites.

As Swartz outlined in a recent press release, all Hearst newspapers will be required to allow for "efficient production or common content sharing," use "outbound telemarketing and self-service ad platforms more effectively," increase their subscription rates, outsource printing, and charge for digital content.

"Exactly how much paid content to hold back from our free sites will be a judgment call made daily by our management," Swartz stated. "Our goal is a business model that seeks, by 2011, to get more than 50 percent of our revenue from circulation revenue and digital advertising sales."

And the same day that Chronicle workers learned that their newspaper might be facing the axe, Hearst cut 75 out of 135 newsroom positions at the San Antonio Express-News in Texas.

As San Antonio Express-News editor Robert Rivard told his staff, "Incremental staff and budget cuts, we are sorry to say, have proven inadequate amid changing social and market forces now compounded by this deepening recession."

"It’s like death in here today," a source, who asked to remain anonymous, said. "Everyone who was laid off is still here, working ’til March 20."

And like the growing pool of newsroom refugees nationwide, the survivors of this San Antonio massacre have since met to brainstorm about other newsgathering business models.

"We all have kids, so we need salaries and insurance," our source confided, "but we’re going to start researching some options, see what’s working and not in other places. The time is ripe."

THE SINGLETON SCENARIO


Meanwhile, sources within the Chronicle — who asked to remain anonymous given the ongoing negotiations — claim that there isn’t much hope that Hearst will come up with innovative solutions, but that there is a chance the paper could be sold to Dean Singleton, the only other major Bay Area newspaper publisher.

Singleton’s MediaNews Group owns the San Jose Mercury News and the Contra Costa Times, and has lost several antitrust cases in recent years. Any deal with the Chronicle would require Department of Justice approval — and would give one owner control of nearly every daily newspaper in the Bay Area.

The media baron refuses to comment on whether he is considering buying the Chronicle.

"We’ll just watch it play out," Singleton told Editor and Publisher’s senior editor, Joe Strupp, last week. "I am not going to speculate on what could happen."

But, as Strupp noted, "MediaNews remains highly leveraged."

Hearst Corporation currently holds a substantial amount of MediaNews debt, owns 31 percent of MediaNews Group newspapers outside of the San Francisco Bay Area, and recently took control of four Connecticut papers that MediaNews was managing for Hearst.

Former Chronicle city editor Alan Mutter believes Singleton could still be in the running.

Observing on his Reflections of a Newsosaur blog that "To wipe out a $50 million loss, let alone make a profit, the [Chronicle] would have to eliminate 47 percent of its entire staff," Mutter later clarified that he believes it’s "extremely unlikely" that the Chronicle will reduce its staff to that extent.

"But, it will try to do some serious cost cutting, and it could be sold, potentially, to MediaNews, because Singleton would not necessarily be expected to put up any money," wrote Mutter, noting that hundreds of people involved in the Chronicle‘s advertising operations could be eliminated if Singleton took over, since ads for MediaNews’ papers are already assembled in India. Another motivation for Hearst to find someone to take over the Chronicle lies in the multimillion dollar printing plant that Hearst just built.

"But no one expects the business to break even now," Mutter said. "If you want to make $20–<\d>$30 million profit over the long term, that’s not a good outcome for a business that has lost $1 billion in recent years."

Michael Stoll, director of the Public Press project, which seeks to launch a nonprofit daily paper, told us he thinks it would be "a real tragedy" if Hearst followed through on any of its Chronicle threats.

"Most San Francisco journalism is generated by reporters at the Chronicle, and its few competitors would be ill-prepared to step in and immediately fill the void," Stoll said.

Concerned that Singleton’s MediaNews could try to make the case that there is a crisis and that the Department of Justice should therefore waive antitrust prohibitions against monopoly ownership, Stoll warned that "the expansion of MediaNews ownership to nearly every other paper in the Bay Area in the last two years has proven to be an unmitigated disaster in terms of a less independent voice from Santa Cruz to Santa Rosa, and from San Mateo to Contra Costa."

The Society of Professional Journalists is calling for a public discussion of Hearst’s threats.

Worried that additional cuts to the Chronicle "will only exacerbate what SPJ perceives as an already growing vacuum of credible reporting and will further limit scrutiny of our public institutions," Northern California SPJ board president Ricardo Sandoval observed that closing the Chronicle "would mean losing the largest source of news for hundreds of thousands of readers in the San Francisco Bay Area."

Asking Hearst to participate in "a high-profile conversation with its community based on the imperative of reinvention," Sandoval said, "We urge journalists, foundations, corporations, the public, and public officials to join us in finding solutions to this increasingly urgent civic challenge."

As University of California at Berkeley journalism professor Bill Drummond warns, "this is not just the decline of the industry. If the mainstream media, which is supposed to be balanced and fair, goes away, if that scrutiny is no longer there, everything will be more partisan and narrower.

"And in this atmosphere where everyone is begging the government to fund their industry, what about the fourth estate?" Drummond said. "Maybe we need the newspaper equivalent of public broadcasting, with pledge drives and bake sales."

City officials and race organizers have dropped plans for a crackdown on partying at the annual Bay to Breakers race in the face of a massive grassroots organizing effort that quickly generated more than 20,000 members opposed to the proposed bans on alcohol, floats, and nudity.

"We’re pleased with the outcome. I think it’s a victory," Ed Sharpless of the group Citizens for the Preservation of Bay2Breakers told the Guardian. "When you have over 20,000 people join your group in two weeks, it means something."

It means that people are tired of the string of crackdowns by Mayor Gavin Newsom (and his special events coordinator, Martha Cohen) that the Guardian has labeled the "Death of fun" (see "Death of fun, the sequel," 4/25/07), which have included canceling Halloween in the Castro District and placing restrictions on the Haight Ashbury Street Fair, How Weird Street Faire, North Beach Festival, North Beach Jazz Festival, and other events.

And the public outcry demonstrates that big events like Bay to Breakers don’t belong to the organizers and sponsors; they’ve become the property of the entire city.

Sharpless was part of a Feb. 27 meeting convened by the Mayor’s Office that included opponents of the crackdown, race organizers, neighborhood groups, and Sup. Ross Mirkarimi, who has been trying to balance complaints about public urination, drunkenness, and trash with his concerns about killing yet another party.

Afterward, the Mayor’s Office issued a statement indicating that floats would be allowed as long as they aren’t used to transport alcohol, urging Bay to Breakers participants to register for the race, and stating that alcohol consumption "will be subject to the laws of California. Race organizers will coordinate with the San Francisco Police Department to proactively remove kegs and glass bottles of alcohol from the race course."

While that alcohol policy was left deliberately vague, those involved with the negotiations and the May 17 event say drinking will be allowed as long as attendees don’t get out of control. As with alcohol, nudity isn’t specifically allowed, but it’s no longer explicitly banned.

"The issue was it had gotten out of hand last year," Sam Singer, a crisis communications specialist brought in by race organizers, told the Guardian. He said the race organizers wanted to put a stop to the mayhem and proposed the restrictions, but eventually agreed to work with the partyers this year.

"There was a request by the pro-float, pro-alcohol group to continue what had been a San Francisco tradition. Now it’s incumbent on them to register for the race so organizers can pay for it," he said. "This debate has created a positive social pressure to be a cool person and to be respectful of one’s self and one’s neighbors."

Opponents of the crackdown agree and say they will work to keep things under control. Or as Citizens for the Preservation of Bay2Breakers wrote in a public statement, "The problems with public drunkenness … we get it and agree. People, you need to act more responsibly. Pace yourself. It’s a long day. Don’t get out of hand and don’t ruin it for the majority of folks who are acting responsibly. Most importantly, take care of your friends and each other."

But there are still outstanding questions about whether race organizers (including for-profit corporations AEG and ING) are providing enough portable toilets and trash receptacles to avoid last year’s problems, concerns that were raised but not resolved on Feb. 26 during a permitting hearing before the city’s Interdepartmental Staff Committee on Traffic and Transportation.

Organizers told ISCOTT they would provide 650 portable toilet this year, compared to 550 last year, and that they would be more concentrated around problem areas such as Alamo Square and the Panhandle. But Sharpless told the committee that still wasn’t adequate, describing last year’s problems as "mostly a logistical issue" and saying the proposed crackdown and hiring of Singer, who often charges $400 per hour, were counterproductive.

"Why is it they bring in such a heavyweight to deal with this when they could have applied their resources to these logistical issues?" Sharpless told ISCOTT. "They want to take away the fun in San Francisco to make a buck."

Longtime runner Tony Rossman, who supports the crackdown, didn’t agree and told ISCOTT, "There is a one-word problem here and that is alcohol. And that requires public enforcement."

But Conor Johnstone, a runner who opposes the crackdown, told ISCOTT that banning alcohol was an attack on the character of the 97-year-old event, rather than dealing with the main stated problems. "I think an increase of 100 Porta-Potties is anemic at best," he said.

Jeremy Pollock, who was representing Sup. Mirkarimi, offered ISCOTT and race organizers a long list of suggestions to mitigate the problems, including using large capacity urinals, creating an end point with entertainment and Dumpsters for those with floats, and setting a cheaper registration tier for those who aren’t serious runners. "Nobody wants to see this race end," he said.

Opponents of the crackdown say they will continue working to resolve the outstanding issues.

"We’re not done, folks. There is still work to be done. Issues to be resolved. Details to be hammered out," Citizens for the Preservation of Bay2 Breakers wrote in a public statement. "What wasn’t discussed at the meeting and tabled for later discussion are the logistical deficiencies we still believe exist with race organizers’ plan for the event. Recent research by our group revealed that the New York Marathon sources 2,250 toilets for 39,000 participants in their race, while AEG race organizers source only 500 toilets for 65,000 participants in Bay to Breakers. Could it be that there are such massive issues with public urination because there simply aren’t enough toilets?"

Mirkarimi was happy with the agreement, but said it didn’t address the logistical concerns he’s been raising. "It’s a good step in the right direction. However, this is predicated on the trust that may not be felt until the day of the race. We were looking for specifics to improve this race."

Radio Africa and Kitchen

Radio Africa and Kitchen is described by its Web site as a "nomadic" restaurant, but if it has anything like a home, it’s Coffee Bar, the Multimedia Gulch spot kitty-corner from Circolo. This juxtaposition isn’t as unlikely as it seems. Although the first thing you smell when you step into Radio Africa is Coffee Bar’s coffee, the smell reminds you that coffee is native to the highlands of east Africa — and Radio Africa’s food is east African in influence.

The maestro of the project is Eskender Aseged. In the autumn of 2004, having cooked professionally in Bay Area restaurants for two decades, he began Radio Africa on a small scale in his own home, serving dinners that reflected the cuisine of his native Ethiopia to groups of 15 or 20 people. Today, more than four years later, the heart of the drill remains much the same: inventive and elegant cooking that emphasizes healthfulness and carefully chosen ingredients in an atmosphere of (sometimes raucous) festivity.

Despite the arresting name, Radio Africa and Kitchen is several steps removed from Africa. It doesn’t even much resemble the Ethiopian restaurants you find along Divisadero Street in the Western Addition. Coffee Bar, as a locale, is a redoubt of pure Mission District monied hipsterdom: a vault of brick, concrete, and stainless steel, with industrial-style lighting, a gigantic, heavy door, and a large mezzanine.

On that mezzanine you will find the flickering light of votive candles, for a monastery effect. There are also big tables for big parties, along with a dining counter overlooking the bar. The Wi-Fi connection must be especially good at the counter, because it seems to attract diners with laptops, who sit there with plates of food while gazing into glowing screens like hardworking controllers at NASA’s Johnson Space Center, gobbling some takeout while maintaining radio contact during a space walk.

I do wonder about the etiquette of peering at a laptop, or into a handheld, while having dinner, especially when the food is as good as Radio Africa’s. Much as I love the traditional way of presenting the highly spiced dishes of Ethiopia and Eritrea — family-style, on mats of injera — I was delighted to find some of the flavors of east Africa handled in a different way. They’ve been passed through a California filter, in a sense. Also I was pleased to find meat de-emphasized, though I like meat. If you’ve been to one of the old-line places, you’ve probably noticed the prominence of beef. Radio Africa favors seafood and chicken instead, and many of the best dishes have no flesh at all.

We were particularly impressed by a green-bean salad ($6) — really an arugula salad with green beans, slivered almonds, dabs of notably creamy goat cheese, and long fingers of white, faintly blushing radish bound together with a simple vinaigrette. A salad like this one reminds us that there is an art to salad-making, particularly in winter, when not only is matériel in short supply but the human response to greens and uncooked vegetables is at its most reluctant and in need of coaxing.

Edamame hummus ($6) was very much like the usual chickpea kind, except with a faint sheen of green. The hummus was dressed with argan oil, which is derived from the pits of a fruit tree native to Morocco and is thought to have many health benefits similar to those of olive oil. For dipping, the kitchen offered rounds of Tartine sourdough baguette instead of the usual pita bread or lavash.

Were the mushroom crostini ($6) mounted on rounds of toasted Tartine bread? The menu did not give the bread’s provenance, and Tartine would be a reasonable guess, but the question was mostly mooted by the tastiness of the topping: a coarse purée of brown mushrooms seasoned with berbere (an Ethiopian form of chili powder) and swabbed onto the toasts along with bits of basil and shreds of manchego cheese, for a hint of tang.

Seared Maine sea scallops ($6) came embedded in a granular purée of cauliflower (about the consistency of riced potatoes) that had been stewed alicha-style. Scatterings of minced chive helped this plate avert a complete white-out, as did the nice crusting on the scallops themselves, which can be overpoweringly rich and sweet but weren’t here.

Usually a special vegetarian plate makes me suspicious, but Radio Africa’s fantasy ($16) was a small ensemble masterpiece. The dramatis personae included lentils in two guises (green were mashed into something like dal; beluga remained whole), an expertly seasoned eggplant caviar, a wintry tagine of fennel and chard spooned over a foundation of couscous, and (also charmingly wintry) a chestnut salsa to bind the players into a whole of still-discernible parts.

The fantasy was so good that the menu’s premier item, a chunk of true Alaskan cod ($20), crusted with flaps of artichoke heart and seated on a low hill of couscous in saffron broth, slightly paled by comparison. We devoured it nonetheless, while noisy birthday parties unfolded at spacious tables on either side of us.

As befits the abbreviated menu, dessert is typically limited to a single possibility, such as vanilla ice cream ($6) — organic, in two scoops — with a couple of fabulously intense lemon cookies, a few blueberries, and a puddling of chocolate sauce, the last two items combining in a strange harmony as well as providing a wealth of antioxidants and going well with coffee, which — not surprising given the circumstances — is available. Wine and beer too.

When the news broke last week that Hearst Corporation was threatening to shut down the San Francisco Chronicle, the pundits across the country raised the obvious question: will San Francisco become the first American city without a major daily newspaper?

I think it’s a little early to say that Chron is actually going to vanish; part of what’s going on is clearly a shot across the bow of the paper’s unions, a warning on the part of tough-guy publisher Frank Vega that he’s deadly serious about cutting costs. That will mean widespread layoffs, outsourcing of union jobs, etc. Hearst is a big corporation run by bean counters, one that has major financial problems at many of its media properties. It’s not going to keep sustaining $50 million a year losses in San Francisco.

But Hearst is also a major political player in the United States, California, and San Francisco, and a big-city newspaper carries with it a lot of influence. Shutting down the Chron would be a huge step, one that the Hearst board members, who include William Randolph Hearst 3rd, a Silicon Valley venture capitalist, are going to do only as an absolute last resort.

What happens if we lose the Chron? Well, in the short term, we’re stuck with the Examiner, which recently lauded Pacific Gas and Electric Co.’s CEO as an icon of alternative energy. I need say no more. In the longer term, something will arise to replace the Chron, probably several Web-only daily newspapers, but they’ll never achieve the clout an old-fashioned morning paper had on the political, cultural, and civic dialogue. Those days are numbered anyway; the urban news media of the future will be smaller, less concentrated, and less individually influential.

I’m not a huge fan of Hearst’s San Francisco flagship, but it’s always a shame to see a newspaper die. And I’m convinced that the creaky old Chron could still survive. But it will need major surgery — not just on the finances, but on the content. Because these days, nobody I know under 30 bothers to read it.

So for Mr. Vega and his editor, Ward Bushee, allow me to offer some hints at reviving the moribund publication:

1. Become a San Francisco paper. Nobody reads the Chron for national news any more. You can get The New York Times delivered or read it on the Web and get far better coverage than anything the Chron offers. So give it up. Go local. And by local I don’t mean Walnut Creek and Orinda; forget the suburban readers and try to convince people in your central circulation area that you have something worth reading every day.

2. Trade C.W. Nevius to the Examiner for a draft choice and a writer to be named later and hire seven young, progressive columnists who can talk about issues that people in one of America’s most liberal cities actually relate to. Run a front-page opinion column every day, by a different one of them — make every powerful interest in the city nervous.

3. Redirect the energy and money from the national news to local investigative reporting. A team of five reporters can break a dozen major stories a year. We do it here on much less.

4. Since David Lazarus left for the L.A. Times, there’s not much muckraking on the business desk. Forget the wire stories and the puff — kick some corporate asses.

5. Hire a liberal editorial page editor.

6. Ray Ratto. Go team.

Save public-access TV!

Sup. Ross Mirkarimi has introduced a measure that might help save public-access TV, in San Francisco and elsewhere. It’s not that radical – just a nonbinding resolution calling on the federal and state government to make a small amendment to legislation that currently threatens the existence of PEG – public, educational and government – programming on cable TV.

But it’s got the giant AT&T all agitated, and lobbyists are descending on City Hall to crush it.

The background is a bit complicated, but I’ll try to make it simple. In 2006, the state of California passed a very bad law called the Digital Infrastructure and Video Competition Act (DIVCA), which took away from cities and counties the ability to regulate cable-TV franchises. Now the state Public Utilities Commission – a crew of pro-industry hacks if there ever was one – has that jurisdiction.

One of the results: The city of San Francisco no longer has the ability to require that the operator of its cable franchise provide money for PEG programming. Meanwhile, an old federal law (from 1934) allows cities to mandate that cable franchises pay for capital facilities for PEG – but not for operating expenses.

And the city’s franchise agreement with Comcast is ending this year, and with it will go some $600,000 in operational funding for the city’s public-access TV. More than a dozen PEG channels in Los Angeles county have already gone dark; that could happen here as soon as June.

Mirkarimi wants the state and the feds (that is, our powerful Congressional delegation and our relatively powerful folks in Sacramento) to revisit this, and make a very modest change in law that would allow franchise money to be used not just for capital expenses but for operating budgets.

AT&T dashed off a letter to Mirkarimi Feb. 27th whining about the measure and insisting that the city should pay the PEG expenses out of its existing franchise-fee money. That money goes to the general fund; at a time when the entire social safety net in San Francisco is about to collapse, who really thinks that money will be diverted to public-access TV?

The measure comes up tomorrow at the board. Seems like a no-brainer to me. Who will the AT&T lobbyists get to?

New push for Harvey Milk Day

Last year, Gov. Arnold Schwarzenegger vetoed legislation by Mark Leno (then an Assembly member and now a Senator) to establish May 22 as “Harvey Milk Day,” honoring the late San Francisco supervisor’s birthday with a “day of special significance” marking his causes and encouraging schools to teach children about his life.
Tomorrow, Leno will try again with Senate Bill 572, and this time he’s appealing with Schwarzenegger’s Hollywood side by tapping Sean Penn, who just won the Best Actor Academy Award for his title role in “Milk.” Leno and Penn will appear at 11 a.m. tomorrow at Tosca Cafe (242 Columbus) and will be joined by Assembly member Tom Ammiano, Geoff Kors of Equality California, activist Cleve Jones (a character in Milk and consultant to the film), and Milk’s nephew Stuart MIlk.
Mindful of not pushing too far in tough fiscal times, Milk Day would not be an official holiday from work, but it would finally recognize a civil rights leader who was ahead of his time.

BERKELEY – Of all the strange things that have happened this winter, perhaps the strangest has been the emergence of large-scale Republican Party opposition to the Obama administration’s effort to keep American unemployment from jumping to 10% or higher. There is no doubt that had John McCain won the presidential election last November, a very similar deficit-spending stimulus package to the Obama plan – perhaps with more tax cuts and fewer spending increases – would have moved through Congress with unanimous Republican support.

As N. Gregory Mankiw said of a stimulus package back in 2003, when he was President George W. Bush’s chief economic advisor, this is not rocket science. Deficit spending in a recession, he said, “help[s] maintain the aggregate demand for goods and services. There is nothing novel about this. It is very conventional short-run stabilization policy: you can find it in all of the leading textbooks…”

SF to host landmark same-sex marriage arguments

All eyes will be on San Francisco this Thursday at 9 a.m. when the California Supreme Court hears oral arguments about whether Proposition 8, which revoked the marriage rights from same-sex couples that the court granted last year, is unconstitutional, thus restoring marriage equality for all Californians.
While there are only 20 seats available to the public (on a first come, first served basis) in the Earl Warren Building courtroom on McAllister Street, the court has recognized the widespread interest in their proceedings by providing an array of other viewing options, including televising the hearing.
There will also likely be several watch parties set up around town, which y’all can list here in the comments section. We’ll also be included some in the Alerts section of next week’s Guardian.

Russoniello and Ryan in the cross hairs

As the city searches for a new police chief, the Board of Supervisors is intensifying efforts to oust the US Attorney for Northern California, Joseph Russoniello, and the former US Attorney for Northern California, Kevin Ryan, who is currently Mayor Gavin Newsom’s top crime advisor, and replace them with folks more in tune with San Francisco values.

Ryan and Russoniello, who were both appointed a year ago, have come under increasing scrutiny since July, when the mayor ordered the city to report undocumented youth to federal authorities the minute these youth are arrested on suspicion of committing a felony.

Immigrant rights groups nationwide have decried Newsom’s decision as robbing youth of their right to due process. But, city insiders say Newsom is refusing to reopen the conversation, in face of a Grand Jury investigation that Russoniello convened. Russoniello has claimed that the city’s previous policy direction, which included flying Honduran youth back to their families, was tantamount to harboring and thus was a violation of federal law.

At last Tuesday’s Board meeting, Sups. David Campos, John Avalos, Chris Daly, Eric Mar, Ross Mirkarimi and Board President David Chiu introduced a resolution urging President Barack Obama and Senators Barbara Boxer and Dianne Feinstein to appoint a new U.S. Attorney for the Northern District of California.

The resolution cites five examples that “highlight Mr. Russoniello’s questionable judgment,” and states that the Board “recognizes the importance of having a U.S. Attorney that understands San Francisco’s diversity, values and commitment to equal justice, especially as s/he works closely with the City’s law enforcement agencies on public safety measures. The resolution also observes that the Board “has a duty to safeguard the well being of its residents and ensure their equal protection.”

The next night, Campos, who came from Guatemala to this country at age 14 as an undocumented immigrant, joined speakers at an immigrant rights forum that denounced recent changes in the sanctuary city ordinance, called for the ouster of Kevin Ryan and expressed disappointment that Newsom did not attend the forum.

“I understand Newsom sent a representative and I appreciate that, but for a lot of people it would have meant a lot if the mayor had attended himself,” Campos told the Guardian.

With the heat on Newsom locally and statewide—many voters in the upcoming gubernatorial race are of immigrant descent and/or have undocumented relatives here—will the mayor meet community members face to face? Or is he afraid of alienating the powerful Police Officers Association and losing vital campaign contributions?

Mayoral spokesperson Nathan Ballard reportedly told the Chronicle that, “the mayor supports Ryan but ‘is willing and eager to listen to feedback from the community.”

Asked if the Mayor has scheduled a meeting yet, Campos told the Guardian, “Newsom has said he wants to meet with me and members of the community, so until I hear otherwise, I will believe that is what is going to happen.”

Feds finally relax pot policies

Might the wasteful U.S. war on marijuana be coming to an end? That possible light at the end of this long dark tunnel was sparked by U.S. Attorney General Eric Holder yesterday when he said the federal government would no longer raid medical marijuana facilities in the 14 states where voters have legalized weed for medical uses.

That announcement comes just days after California Assembly member Tom Ammiano introduced a bill that would decriminalize and tax marijuana, even pot consumed for strictly recreational reasons by healthy Californians. Advocates are hailing the twin announcements as a refreshing change from the ridiculously intolerant rhetoric that has characterized the national narcotics debate for decades.

Details of Chronicle ‘s cost-cutting/closing scenarios emerge

Proposed cuts at the Chron will be painful and could even be fatal for the city’s most influential daily.

Cutting half the Chronicle’s staff. Outsourcing operations. Busting the union. Selling the Chronicle to media baron Dean Singleton. Closing down the paper entirely.

All these equally strange and bleak media futures were hovering on the Chronicle’s horizon, as representatives for the paper and Hearst Corporation met with leaders of the Northern California Media Workers Guild today, in an effort to keep the Chronicle open, after Hearst announced it will close San Francisco’s daily paper, if cost-cutting plans don’t pan out.

After a morning meeting spilled into the afternoon, representatives from Northern California Media Workers Guild released a bulletin, saying they met with reps from the Chron and Hearst to discuss “the cost-cutting proposal.”

“We opened the meeting by underscoring our commitment to our membership and the community to do all we can to reach an agreement that will keep The Chronicle open and return it to profitability,” Guild representatives stated.

But Jerry Roberts, a former Chronicle managing editor, burst out laughing, when informed by phone that one of the aims that emerged from that meeting was to return to profitability a paper that has lost $50 million a year.

“That will definitely be an uphill slog,” said Roberts, who left the Chronicle seven years ago to become editor of the Santa Barbara News-Press and is now an adviser to the Daily Nexus, UC Santa Barbara’s student newspaper.

Loving the enemy

REVIEW Nation, ethnicity, family, friends, gender, lover — where do our true loyalties lie? More to the point, when our multiple loyalties slip out of concentric orbit and collide, how much say do we really have in the matter? These questions arise provocatively from two very different plays making their Bay Area premieres.

In the first, Golden Thread’s generally sturdy West Coast premiere of Joyce Van Dyke’s A Girl’s War: An Armenian-Azeri Love Story, an aging Armenian American fashion model, Anna (Ana Bayat), returns to the war-torn village of her youth determined not to be affected by the ongoing ethnic strife that has just taken the life of her brother (Adrian Cervantes Mejia) and racked the Azerbaijani region of Karabakh since the late 1980s — converting her stolid yet hot-tempered mother (Bella Warda) into a machine gun–toting foot soldier for the Armenian cause. Almost flaunting her own aloofness and disapproval, Anna even resists calling herself Armenian and soon falls in love with a returning member of her family’s onetime Azeri neighbors, now antagonists: a passionate young deserter (Zarif Kabeir Sadiqi) who arrives stealthily one day at her mother’s house, which he and his family briefly occupied years before.

Van Dyke’s 2001 play opens on a world seemingly apart, however, as Brit fashion photographer Stephen (Simon Vance) snaps photos of the still-striking Anna, his old flame and muse, glowering at him in some haute-couture idea of battle garb. The contrast is key and works its way into the second setting in Karabakh, when Stephen and his cheerful but recently shaken assistant Tito (Mejia) arrive after escaping anti-U.S. feelings during a harrowing trip to Turkey. Here in her mother’s house, Anna’s two worlds collide even as she insists she needs no land, passport, or language to define her. Her stoic but long-suffering mother, however, shows little patience for her daughter’s flighty Western cosmopolitanism, and we are left with our own sympathies unsettled, fraternizing with all sides.

Along the way, the play neatly works a certain doubling conceit. The same actor playing the Italian American Tito, for instance, also plays Anna’s recently deceased brother, a spectral presence in the form of the far more severe but equally sensitive Seryozha. The implications are subtle rather than crude, suggesting the dramatic shaping done by circumstance across a universal segment of young manhood. And the climax, in yet another doubling, underscores the point resonantly, as another two seemingly very different characters lie side by side, brought together in death — the most democratic of states — and made mirror images of each other. It’s an effect that might have been overplayed, but under artistic director Torange Yeghiazarian’s confident direction it happily comes off with matter-of-fact simplicity. The play as a whole succeeds in similar fashion, overshadowing, if not altogether escaping, its more maudlin and moralizing tendencies with fitting dramatic tension, unexpected twists, and thematic delicacy.

TO HELL AND BACK Lorraine Hansberry Theatre, meanwhile, offers an admirably complex take on love and loyalty in the context of the proverbial war of the sexes, in director Buddy Butler’s graceful Northern California premiere of William A. Parker’s Waitin’ 2 End Hell. An African American couple (a towering Alex Morris and a slyly understated Pjay Phillips) find their relationship hitting the skids after 20 years of marriage, dividing along lines of gender solidarity the four friends who’ve shown up to celebrate their anniversary. If the title — playing on the Terry McMillan novel — isn’t that funny, Parker’s naturalistic dialogue offers consistent laughs and truths, pivoting expertly on the comic and tragic dimensions of male-female rivalry in the context of African American experience. There is one seeming misstep late in the plot — a slightly hard-to-believe change of heart evoked at gunpoint — but this is a surprisingly powerful and well-rounded comedy about love; the entwined politics of race, class, and gender; and the long haul every family faces.

Listening to Keelay & Zaire’s debut, Ridin’ High (MYX Music Label), is like being transported back to Bay Area hip-hop in the early ’90s. Remember those glory days? Hobo Junction and Hieroglyphics battled for supremacy; the Invisibl Skratch Piklz and Bomb Records sparked the turntablism movement; and Celly Cel, Spice-1, Richie Rich, and the Click created mob music.

Production team Tim "Zaire" Lewis and Kyle "Keelay" Pierce evoke that era with balletic numbers such as "I’m on Swerv," with its Zapp-style — not T-Pain style — Auto-Tunin’, and laid-back gangsta soul like "Alright with Me" and "Nurf to the Turf." The cast itself isn’t Bay-specific. Its geographical makeup — a product of connections made through MySpace pages and online community forums — ranges from Raleigh, N.C. (Phonte Coleman and Darien Brockington) to Bloomberg, N.J. (rising producer Illmind’s group Fortilive). It’s a result of Internet hustling, and the chorus line raps, sings, swaggers, and jostles for attention. But the smooth, breezy, Dayton-tires-rolling-on-concrete tone remains.

"We really just wanted to make something that would give the listener the feeling of riding around in a car," says Keelay by phone. A Salt Lake City transplant, he enrolled at San Francisco State seven years ago. "After college, I just didn’t want to leave," he remembers. "I loved it in the Bay Area. It quickly became my home."

Keelay met Zaire on the UndergroundHipHop.com — once ughh.com — message boards. Both work 9-to-5 gigs: Keelay is a computer technician for Wells Fargo. Zaire, who lives in Newport News, Va., is a government contractor who mysteriously performs "intelligence work." ("I don’t know what he does!" answers Keelay when pressed for details.) Without a label deal, they painstakingly cobbled together Ridin’ High over two years, paying for the guest appearances themselves, though, Keelay adds, "a lot of people were really generous," and did it for free. "Me and Zaire had to send beats and sessions back and forth" via e-mail, he says. "We did it all through the Internet."

Now MYX Music Label (MML), who signed Keelay & Zaire to a deal last fall, has chosen Ridin’ High as its first major release. MML is a subsidiary of ABS-CBN Global, a Philippines media company that launched a U.S. version of MYX TV in 2007. According to Karim Panni, who manages the imprint, the "music lifestyle channel" can only be seen on DIRECTV in the Bay Area. But it is working on various deals that will widen its reach. Meanwhile, Comcast carries MYX’s most popular show, Built from Scratch, through its On Demand channel.

"There’s a lot of work that goes into getting added onto Comcast. But we’re working on it," says Panni, also known as Nightclubber Lang, one-third of the Seattle group Boom Bap Project. "I was on tour with Brother Ali, and the owner [of MYX] asked me if I wanted to run his record label."

It seems odd that a multimedia company with international ambitions would choose an indie rapper to launch a record label. And judging from MML’s release slate — including 20 C Energizers, described in press materials as a "hip-hop CD produced solely by Asian MCs, producers, DJs and singers," and MYX TV-affiliated DVDs such as Slanted Comedy, which showcases Asian American comedians — MYX appears to target Asian youth culture. But when asked about MYX’s Asian identity, Panni bristles. "I’m not trying to be typecast as an Asian label," he says. "We’re not trying to market to a niche audience. We’re reaching out to everybody."

"These days, with the Internet, the lines between major and underground are really fine. So instead of looking for this type or that type of rapper, I just look for the people who are making really good music that I would like," Panni adds. His expectations for Keelay & Zaire are modest: "Really, to establish themselves in the Bay Area, in the California market, and then become one of the elite production duos in the game. This is a good jump-off to show what they can do."

THE FACE IN THE LENS: ANONYMOUS PHOTOGRAPHS

A shop in the Tenderloin sells anonymous photos. The pictures are messily packed in boxes and labeled according to whether the subject, sometimes but not always graphic (there are plenty of head shots of failed actors, for example), is heterosexual or homosexual. As digital images fly and float through the Internet, I’ve thought about those boxes of snapshots, their mix of allure, mystery, and depressing banality. With The Face in the Lens: Anonymous Photographs, a sequel to his acclaimed monograph Anonymous (Thames and Hudson, 2005), Robert Flynn Johnson both expands and refines the type of gathering and organization I discovered in that store.

Alexander McCall Smith’s brief intro, which imagines stories around some of the book’s images, isn’t as effective as Johnson’s essay, which connects obvious critical sources such as Susan Sontag with aphorisms on sight and photography from W.H. Auden and Jean Cocteau. Johnson is out to find the many spaces between the sentimentality of humanistic projects such as the 1955 book and exhibition, The Family of Man, and the morbid focus of monographs such as 1973’s Wisconsin Death Trip. He does so with 1880s daguerreotypes and late-1980s color snapshots. We see Robert F. Kennedy on the day of his death, mass hangings in the Soviet Union, flying leaps from flaming buildings, storm troopers in suburban backyards, kids smoking, infants in dresses holding rifles, men in drag or kissing by Christmas trees, and naked women soldering. Few images are obvious or dull. Some are worthy of a Ralph Eugene Meatyard or Weegee. The power of others resides in the relationship between clueless photographer and defiant or sad subject. BLANK SPOTS ON THE MAP: THE DARK GEOGRAPHY OF THE PENTAGON’S SECRET WORLD

In 2006’s Torture Taxi: On the Trail of the CIA’s Rendition Flights (Melville House), Trevor Paglen worked with former Guardian writer A.C. Thompson to reveal the subculture of "planespotting" and the realities behind terms such as "rendition" as practiced by clandestine U.S. forces. The book also provided an interesting entryway into, or extension from, Paglen’s work as a visual artist, with Thompson’s journalistic voice seemingly braided in and out of Paglen’s more academic tone.

Blank Spots on the Map is a more mainstream book, as evidenced by its publisher. This aspect has its assets and drawbacks. One asset is that Paglen’s writerly voice has improved greatly, growing more versatile and characterful as it shifts to first-person. A look at the rendition programs of the CIA is just one element of his overall effort here, which involves revealing hidden spots used by the U.S. for covert activities throughout the globe — and in the skies above it. Early on, he cites facts showing that the number of federal government employees working on classified projects far outnumbers those working aboveground. At times, Paglen relates discoveries in a manner that suggests that he alone has made them. But for the most part, Black Spots is a bracing, real-life through-the-looking-glass antidote to Tom Clancy–style escapism. (Huston)

Losing the tax argument

EDITORIAL The lead topic on the local cable TV show City Desk News Hour Feb. 21 was the state budget, and a panel of local reporters were talking about the mix of tax increases and service cuts the Legislature finally passed. After a bit of back and forth, Scott Shafer, host of KQED’s California Report, piped up. "Everyone knows it’s a bad idea to raise taxes in a recession," he said.

Shafer, who was a press secretary to former Mayor Art Agnos, is hardly a conservative commentator. In fact, at the risk of damaging his credentials as an unbiased reporter, we might even call him a liberal. And to judge from the response of most of the panel, nothing he said was particularly controversial. Sure, raising taxes in a recession is bad; so is cancer, and violent crime. Next question.

But that’s not just a limited viewpoint — it’s factually inaccurate. Raising taxes during a recession can be an excellent economic idea, if it’s done right. Because the one thing almost every credible economist outside of the far-right intellectual swampland agrees on these days is that cutting government spending during a recession is a terrible idea — and if the only way to keep the public sector jobs, the social services, and the welfare payments going is to raise taxes, then raising taxes on those who can afford to pay is not only good politics, it’s good policy.

And it’s infuriating that this point seems to have dropped out of the mainstream of debate. That’s a major failure of the Democratic leadership, in California and nationwide.

Historians can argue forever about the direct impact the New Deal had on ending the Great Depression. But it’s pretty clear that what Nobel Prize winning economist Paul Krugman calls the great jobs program of World War II turned the American economy around. And during World War II, tax rates, particularly on the wealthiest individuals and corporations, were exceptionally high. The top marginal income tax rate exceeded 80 percent. Corporations that made more than a modest return paid a high excess-profits tax. The high income tax rates on the richest Americans remained through the postwar boom era, a time when inequality declined and overall wealth grew.

That money went into the public sector, not just for the war but for retooling and rebuilding U.S. industry. High taxes on the rich paid for the interstate highway system, the University of California system, the California Water Project, the birth of the Internet. It took almost half a century for the Republicans and no-taxers to wreck the economic gains of that high-tax era.

And yet, despite all the consistent, clear evidence, we still hear the news media, the commentators, and even liberal Democrats saying that tax cuts are good for the economy and tax hikes are bad.

What we’ve got here is failure to communicate.

One of the most important goals of the next year or two, under the Obama administration, is to change the national debate over public and private priorities. That won’t be easy. President Obama has started off in the right direction, although the Republicans forced him to include several hundred billion in wasteful tax cuts in his stimulus bill. The tax hikes in the state budget plan are almost entirely regressive (sales taxes and a flat increase in the income tax.)

Here in California, and here in San Francisco, elected officials who claim to represent the Democratic Party’s future need to stop mouthing the old Republican line. None of the Democratic candidates for governor, including Mayor Gavin Newsom, have been our front about the need for more government spending, even if it means higher taxes on the wealthy (say, a business tax that hits harder on the biggest and less so on the small). In fact, Newsom has taken the opposite line, writing in a Feb. 13 San Francisco Chronicle op-ed piece that "we have to reduce spending." The San Francisco supervisors are at least talking about new revenue sources, but polls show that will be a hard sell.

Why do the polls show that? Because people like Newsom — and to some extent, the supervisors — aren’t using their bully pulpits to change the tone of the discussion, to make the case for economic sanity, to challenge the demented wisdom that’s brought us to this nightmare.

That has to change, now, or there will be no way out. *

‘The end of the goddamn family dog’

Former Bottom of the Hill and DNA Lounge doorperson Greg Slugocki wakes up every morning at 4 a.m. to feed and care for 75 rescued dogs at Milo Sanctuary, one of the largest dog and cat rescue sanctuaries in the country. It’s one-third the size of Golden Gate Park and tucked in the mountains of Mendocino County, north of Ukiah.

Slugocki has worked like a dog since he was hired last November, part of a crew of two who cover 283 acres of mountainous terrain. But it’s something else that has recently made his head spin.

"The rate of animals we’ve had to take because of foreclosures is astronomical," Slugocki said. "I’ve taken more dogs in the last three months than in the last two years."

Milo Sanctuary holds adoptions in Berkeley, Oakland, and San Rafael, and he communicates daily with Bay Area shelters and rescues, which also have reported unprecedented increases in animals reluctantly turned over by their desperate owners.

Slugocki may be in the backwoods of Mendocino County, but he’s not alone in this dilemma. Shelters all over the country are reporting rising numbers of dogs, cats, horses, and all kinds of family pets made homeless by the home foreclosure crisis.

In January, San Francisco Animal Care and Control — the municipal shelter and adoption department obligated to take all animals — documented, for the first time, an unprecedented increase in owner-surrendered animals. The report found that since August 2008, there’s been steady monthly increase in such animals, amounting to a 13 percent average rise since last year. Last month saw the highest number of owner-surrendered animals, with an increase of 35 percent.

Though there may not be a clear, quantifiable way of determining whether those owner-surrendered animals are in fact casualties of the foreclosure crisis, animal rescue folks say there is overwhelming anecdotal evidence that this is the case. "Our rescue partners are stretched," SFACC director Rebecca Katz told the Guardian. "We’re stretched."

Indeed, almost every kennel contains a dog with a tag reading "owner- surrender." Animal Care and Control runs a "no kill" shelter — which means animals are euthanized only if they are too sick to be treated or too aggressive to qualify for adoption — has had to spill some of its new arrivals over into its adoption kennels rather than give all the new arrivals a chance for the owners to reclaim them.

"I’ve been dealing with this shelter for 15 years," said Paley Boucher, founder of volunteer-run Rocket Dog rescue, which saves almost 200 dogs from lethal injection each year. "It used to stand out when you saw a dog that was owner-surrendered. But now almost all of them are." Linda Pope with Nike Animal Rescue Foundation says dogs adopted and returned due to foreclosures is an entirely new phenomenon to the center.

Cat Brown, deputy director of the San Francisco SPCA, reported a rise in owner-surrendered animals. "We feel it’s directly related to the economy," she added. "It’s about people losing their jobs and thinking about what they can give up."

Gary Tiscornia, executive director of Monterey County’s SPCA, says there have been a high number of foreclosure animals and a lack of communication between the shelters and the banks, real estate agents, property inspectors, and other entities that find abandoned animals in vacated homes.

Tiscornia said that Realtors in California have found animals in all kinds of conditions in vacated homes, including rottweillers abandoned with a few bags of food and a tub of water, and a dog left for dead in an empty house. It hasn’t always been the case that such incidents were reported to animal shelters.

The disconnect between corporate entities and shelters has been exacerbated by California laws requiring that inspected property, including animals, be left untouched. A new law that went into effect last month addresses the problem. Assembly Bill 2949 requires anyone who encounters an abandoned animal in a property that has been vacated through lease termination or foreclosure to immediately contact a local animal control agency.

The American Society for the Prevention of Cruelty to Animals (ASPCA) issued a statement on foreclosure animals Jan. 29, offering the following advice to those facing foreclosure or eviction: Check with friends, family and neighbors to see if someone can provide temporary foster care for your pet until you get back on your feet. Make sure pets are allowed — and get permission in writing — if you are moving into a rental property. Contact your local shelter, humane society, or rescue group in advance of moving, and provide your animal’s records to help it get placed in an appropriate home.

To love and lose a home is a hard thing, but to love and lose a home and a furry family member is worse, especially when people don’t know where their pet will end up. "People don’t know what to do," said Boucher, citing an example of a Bay Area woman who kept her dog in the backyard of her foreclosed home long after she had moved, and another of a family that asked the subsequent owners of their foreclosed home to care for their dog.

"We’re perceived as a no-kill city, but that’s just not true," said Boucher, who rescues pit pulls, the most frequently euthanized of all dogs. Like many rescue agents, Boucher disagrees with the standards set by the temperament tests that determine whether a dog is suitable for adoption, arguing that many perfect dogs would not pass the test.

Slugocki also takes issue with temperament tests. "Let’s say I’m a dog that hasn’t eaten for weeks and I get picked up and taken to a shelter and they put down a bowl of food as part of the temperament test. Take it away and see what I’ll do."

"This is a huge disaster, a quiet emergency," Boucher said. "I hope people can open their minds to fostering an animal."

Despite the spike in economy-related homeless animals, Katz says SFACC is still under control, at least for the time being. "We have not seen an increase in euthanasia and we hope not to." About 84 percent of animals that end up at the SF shelter are saved, compared to the depressing national average of 30 percent.

"We do everything we can to save animals’ lives. We reach out to every rescue we know of," Katz said.

But with shelters, rescues, and sanctuaries swamped with a growing wave of owner-surrendered pets, caring for the displaced animals is bound to get tougher, particularly if foreclosure crisis gets worse, as many economists predict. And with budget cuts in the offing in the city, SFACC staff fear cutbacks could drive up euthanasia rates.

Slugocki says his sanctuary has something other shelters don’t: space. He has 283 redwood-adorned majestic acres of it, and he’s willing to take every dog, no matter how many have failed the temperament tests that would guarantee a swift lethal injection at the pound.

"I can take dogs that don’t stand a chance. I can take them crippled, heart worm positive, deaf, blind, you name it," Slugocki said. Half of the 75 dogs at Milo are unadoptable and will live peacefully among the redwoods for the rest of their days. He says he can take up to 1,000 dogs but he’s missing one thing: sufficient staff to build enough dog pens and feed and care for a small city of dogs every day.

"I desperately need volunteers," Slugocki said. "I know there is a crowd of people, that 30 to 60 tattooed, pierced, old rock ‘n’rollers, new Buddhists, lifelong punks who are older and maybe have kids now." For now he’s taking as many dogs as he has pens for and is working 14-hour days to help save the discarded critters of the economic crisis.

"It’s the end of the goddamn family dog," Slugocki lamented. "Nobody who has a dog and has lost a home will ever think about having a dog again."

A search for patterns in the light — and in the dark

ENIGMATIC: TREVOR PAGLEN AND THE EVIDENCE OF THINGS NOT SEEN

Trevor Paglen’s section of the 2008 SECA Art Award exhibition is somewhat centrally located — you have to pass through it to get to Jordan Kantor’s room, as well as to a small room containing pieces by all four awardees. This positioning resonates, for Paglen is nothing if not conscious of maps and their meanings, and his contributions have visual connections to the other three artists. The dizzying, multicolored swirls of Nine Reconnaissance Satellites over the Sonora Pass, a c-print from 2008, aren’t far from Tauba Auerbach’s post-op art graphics. The night skies in Paglen’s photography aren’t far from the deep blues and flaring lights of Kantor’s 2008 oil-on-canvas Untitled (lens flare), where the painted camera effects are also suggestive of one of Kantor’s Paglenesque earlier subjects, the 1986 Challenger explosion.

Such ties are helpful, because the flagrantly governmental subject matter and complicatedly political perspectives of Paglen’s work make it too easy to downplay or ignore its artistic facets. The white spots of 2008’s PARCAE Constellation in Draco (Naval Ocean Surveillance System, USA 160) are a photo-corollary to those found in Bruce Conner’s lovely late-era ink drawings. (Like Paglen, the late Conner kept his eye on activities the U.S. hides in plain sight, and that awareness adds undercurrents to works of his that might otherwise be coded as purely spiritual.) When Paglen, from a mile away, uses a long-lens camera to uncover the ambiguous activities of an unmarked 737 in a black spot in Las Vegas, I’m reminded of the telescopic images of cruelty at the end of Pier Paolo Pasolini’s 1957 Salò. But unlike Pasolini, Paglen is far from being in full charge of the staging, so his seductive images can only blurrily hint at barbarism or sinister motive.

"Photography — and this is especially true after September 11 — is a performance," Paglen told Thomas Keenan in an Aperture article from last year. "To photograph is to exercise the right to photograph. Nowadays, people get locked up for photographing the Brooklyn Bridge." Paglen’s pictures are the most successful portion of his SECA contribution — his presentation of emblematic Pentagon patches, while provocative and even aesthetically playful, raises (much like William E. Jones’ so-called 2007 film Tearoom) problems of authorship. By looking up at the sky and revealing that it’s looking back down at us, Paglen creates a grounded answer to the work of aerial photographers such as Michael Light, whose visions reorient one’s perspective. Paglen isn’t out to make you see clearly. He wants you to look deeper. And wonder. (Johnny Ray Huston)

HER EMPIRE OF SIGNS: NOT-SO-RANDOM NOTES ON TAUBA AUERBACH

Tauba Auerbach is shaking up her spin-off sphere of the so-called Mission School with optical investigations into that interzone between the figurative and abstract, representational systems and what they communicate, order and chaos. This Bay Area native — at 27, the youngest of the current SECA Award winners — was likewise shaken to the core as an eight-year-old during the 1989 Loma Prieta earthquake. "Actually I was at gymnastic class on Judah Street and on the uneven bars," she recalls by phone from New York City, where she now resides. "I was swinging from the low bar to the high bar when it just moved away from me and I fell. It was absolute chaos. Adults screaming conflicting instructions to us. I saw the windows bow in and out, and I remember driving home over the hill and seeing smoke and thinking our house was gone."

The memory bubbles up — as vivid and close to the surface as Auerbach’s perusal of chance and broken glass, Shatter II (2008), in the SECA exhibition — while she talks about her latest project: a piece for the Exploratorium’s "Geometry Playground," which opens in September. The title sounds like a perfect fit: a brain-teasing sense of play underlies many of Auerbach’s projects, including the design of new mathematical symbols for Cambridge University logician Byron Cook’s research into computer science’s famed termination, or halting, problem. "I think there are shortcomings in any coding system," she muses. "Binary is so interesting because the components are so limited…. Every time you want ambiguity in a binary system, you have to simulate it."

Auerbach’s darting intelligence peels off in many directions, much like her eye-boggling patterns. The artist’s old day job, in which she learned the lost art of sign painting at New Bohemia Signs in the Mission District, dovetails with her witty, abstracted deconstructions — or explosions — of writing and semaphore systems, assorted alphabets, Morse code, and eye charts. Two such 2006 works, The Whole Alphabet, From the Center Out, Digital V and …VI, which layer letters drawn from a digital clock, are on display at SFMOMA.

Penetrating glances into chaos and change yielded Auerbach’s largest pieces — the 2008 Crumple paintings — in which she crumpled paper, photographed the results, and then translated the creases onto canvas with halftone printing and paint carefully applied by hand. The folds materialize as one steps further back — and break down into dizzying pixels close up. Multiple entry points exist down this rabbit hole, first carved out by Op artist Bridget Riley. But as with Auerbach’s 2008 Static chromogenic prints, which saw her looking for randomness in analog TV static, the hidden spectrums and other visual tricks are rendered with an elegance a scientist would appreciate. NEGATIVE LIGHT: BEYOND THE CANDID CAMERA WITH JORDAN KANTOR

In Jordan Kantor’s paintings, meaning is candid. When the word "candid" entered the English language in the 17th century, it was closer to its Latin roots, meaning "bright," "light," "radiant," "glow," or "white," with whiteness symbolizing purity and sincerity. Later, as the word approached then copulated with the critical language of photography — that crazy new field of "light writing" initially accused of everything from demonic possession to being a potential assassin of traditional visual arts like painting — "candid" gave birth to its common usage today, meaning "frank," "blunt," "severe," a harsh snapshot, brutally honest vision. So severity in art became intertwined with truth.

Kantor’s local gallery, Ratio 3, with its emphasis on projects’ overall coherence, is a welcome home to his current trajectory. His pieces for the SECA Art Award exhibition are alive with many truths at once, their spaces equally negative and positive. The three Untitled (lens flare) paintings and Untitled (HD lens flare), all from 2008, make you step back, only to feel as if your are standing closer than before. Untitled (Surgery) (2006–07) and Untitled (Eclipse) (2008) glow with negative light. This work is in stride with Kantor’s participation in important group shows at Galeria Luisa Strina in São Paolo ("This Is Not a Void," 2008) and New York’s Lombard-Freid Projects ("Image Processor," 2007) that dealt with our unstable relationship with images. It confirms that he is a photographer who just happens to use paint. I see aspects of Linda Connor’s slow, large exposures here, as well as Cindy Sherman’s foxes-in-the-headlights humans.

Kantor isn’t hardened by academia, though he has a PhD from Harvard and teaches at California College of the Arts. The brilliant candidness in his pictures is tied to an aesthetic understanding of human desires and scientific pursuits, but also to a humanistic refusal to be neutral. If you spend enough time with his work, you start to see that it is candid in its celebration, not just in its criticism. It reminds me of the ending to poet James Wright’s "A Christmas Greeting," from Shall We Gather at the River (1963), where the dead and the living ask the same questions: "Charlie, I don’t know what to say to you," the poet pines to someone he might have known or just imagined, "Except Good Evening, Greetings, and Good Night, / God Bless Us Every One. Your grave is white. / What are you doing here?" (Ari Messer)
