Act One: The Middle Class

MEXICO CITY (August 4th) — Jacinto Guzman, an 80 year-old retired oilworker from Veracruz state, plants himself in front of the headquarters of the Halliburton Corporation on the skyscraper-lined Paseo de Reforma here and recalls the great strikes of the 1930s that culminated in the expropriation and nationalization of Mexico’s petroleum reserves.

Dressed in a wrinkled suit and a hard hat, the old worker laments the creeping privatization of PEMEX, the national oil corporation, by non-Mexican subcontractors like Halliburton, which is installing natural gas infrastructure in Chiapas. But he is less agitated about the penetration of the transnationals in the Mexican oil industry, or even Halliburton’s craven role in the obscene Bush-Cheney Iraq war, than he is about the fraud-marred July 2nd presidential election here.

The sign he holds reads “No A Pinche Fraude” (No to Fucking Fraud!), referring to Halliburton’s membership in a business confederation that financed a vicious TV ad campaign against leftist Andres Manuel Lopez Obrador (AMLO), who insists that he won the July 2nd election from right-winger Felipe Calderon, to whom the nation’s tarnished electoral authority, the Federal Electoral Institute (IFE) awarded a razor-thin and much questioned “victory.”

Mr. Guzman’s appearance at Halliburton on a Friday at the end of last month was one of myriad acts of civil resistance invoked by Lopez Obrador at a July 16th Mexico City assembly that drew more than a million participants. The campaign is designed to pressure a seven-judge panel (the “TRIFE”), which must determine a winner by the first week in September, into opening up the ballot boxes and counting out the votes contained therein — “voto por voto.”

Zeroing in on U.S. transnationals that purportedly backed Calderon, AMLO’s people have invaded Wal-Mart, picketed Pepsico (its Sabritas snack brand was a big contributor to the right-winger’s campaign), rented rooms in big chain hotels (Fiesta Americana) and dropped banners from the windows decrying the “pinche fraude,” and blocking all eleven doors at the palatial headquarters of Banamex, once Mexico’s oldest bank and now a wholly owned subsidiary of Citygroup.

“Voto por Voto!” demonstrators chanted as the bankers smoked and fumed and threatened to call the police.

Demonstrators also blocked the doors at the Mexican stock exchange and surrounded the studios of Televisa, the major head of the nation’s two-headed television monopoly, both heads of which shamelessly tilted to Calderon before, during, and after the ballots were cast.

Seated on a tiny folding chair outside of Banamex, Elena Poniatowska, one of Mexico’s most luminous writers and the recent winner of Spain’s coveted Cervantes Prize, reflected on the civil resistance: “We have always seen the workers demonstrate here in the Zocalo, but this is all very new for our middle class. The middle class protests too, but in the privacy of their own homes. Now we are out of the closet.”

Ironically, the concept of peaceful civil resistance by the middle class was pioneered by Felipe Calderon’s own party, the PAN, after it had been cheated out of elections in the 1980s by the then-ruling PRI. The PANistas uncharacteristically blocked highways and went on hunger strikes, and even imported Philippine trainers, veterans of Corazon Aquino’s civil resistance campaign against Ferdinand Marcos, to teach their supporters new tricks.

Recently AMLO’s party, the Party of the Democratic Revolution or PRD, stole a page from the PANista bible by holding a rally at a Mexico City statue of the right-wingers’ father figure, Manuel Clouthier. During the stolen 1988 presidential election, Clouthier demanded a ballot-by-ballot recount and coined the now ubiquitous phrase “voto por voto.” The PRD gathering around the statue of “Saint Maquio” left Calderon and the PAN speechless for once.

The PRD crusade could be labeled “civil resistance lite.” Led by Poniatowska, opera singer Regina Orozco, and comic actress Jesusa Rodriguez, public demonstrations have been more showbiz than eruptions of mass outrage. Nonetheless, Televisa and TV Azteca, Calderon and the PAN relentlessly rag Lopez Obrador for “fomenting violence,” purposefully ignoring the real daily violence that grips Mexico’s cities as brutal narco gangs behead rivals and massacre their enemies in plain public view.

Act Two: Bad Gas

Hundreds of steaming AMLO supporters pack the cavernous Club de Periodistas in the old quarter of the capital, where computer gurus will diagnosis the complexities of the cybernetic fraud Lopez Obrador is positive was perpetrated by IFE technicians this past July 2nd and 5th during both the preliminary count (PREP) and the actual tally of 130,000 precincts in the nation’s 300 electoral districts.

The experts are as convinced as the audience that the vote was stolen on the IFE terminals, but have many theories as to how. They speak of arcane algorithms and corrupted software. Juan Gurria, a computer programmer who has dropped in on his lunch hour to audit the experts, recalls the 1988 election which was stolen from leftist Cuauhtemoc Cardenas by the long-ruling (71 years) PRI in the nation’s first cybernetic computer fraud. “In 1988, they had to shut down the computers and say the system had crashed to fix the vote – but in 2006, the IFE kept the system running and we watched them steal it right before our eyes” Gurria contends, “the difference is they have better computers now.”

18 years ago, with computer fraud still in its infancy, the PRI had to resort to hit men to carry out its larceny. Three nights before the election, Cardenas’s closest aide, Francisco Xavier Ovando, and his assistant, Ramon Gil, were executed blocks away from the Congress of the country after reportedly obtaining the password to the PRI computer system, upon which the results were being cooked in favor of its candidates, the now universally reviled Carlos Salinas de Gortari. So far, Computer Fraud 2006 has been less messy.

Although the subject is dry and technical – at one point excerpts of an abstruse Guardian of London analysis by University of Texas economist James Galbreath (son of John Kenneth) was read into the record in English – AMLO’s supporters mutter and grumble and nod their heads vigorously. “Asi es!” – that’s just the way it happened! “Voto por Voto” they rumble, “Casilla por Casilla!” after each expert scores a point. Whether or not the fix is in, they are convinced that they have been had.

The PRD is trying to keep a lid on the bad gas seeping from down below. A few days after July 2nd, Felipe Calderon, who AMLO’s people have derisively dubbed “Fe-Cal,” came to this same Club de Periodistas to receive the adulation of a gaggle of union bosses. When he tried to leave the club, he was assailed by street venders howling “Voto por Voto!”

Calderon was quickly hustled into a bullet-proof SUV by his military escort, but the angry crowd kept pounding on the tinted windows. One young man obscenely thrust his middle finger at the would-be president, The scene is replayed over and over again on Televisa and Azteca, sometimes five times in a single news broadcast, graphic footage of the kind of violence AMLO is supposed to be inciting.

Act Three: In Defense of the Voto

Lopez Obrador fervently believes he has won the presidency of the United States of Mexico. He says it often on television just to needle Calderon. The proof, he is convinced, is inside 130,000 ballot boxes that he wants recounted, voto por voto.

The ballot boxes are now stored in the Federal Electoral Institute’s 300 district offices under the protection of the Mexican army. Nonetheless, in Veracruz, Tabasco, and Jalisco among other states, IFE operators have broken into the ballot boxes under the pretext of recovering lost electoral documentation. AMLO is suspicious that the officials are monkeying with the ballots, adding and subtracting the number of votos to make them conform to the IFE’s incredible computer count. Hundreds of ballot boxes contain more votes than voters on the registration lists, and more ballots have been judged null and void than the 243,000 margin of Calderon’s as-yet unconfirmed victory.

To this end, Lopez Obrador has strengthened encampments of his supporters outside the 300 electoral districts. In Monterrey, a PANista stronghold, thugs attack the encampment, beating on AMLO’s people and tearing down their tent city. Rocks are thrown at his supporters in Sinaloa; drivers speed by hurling curses and spitting on them.

Outside the Mexico City headquarters of the TRIFE, the seven-judge panel that will have the ultimate word as to whether or not the votos are going to be counted out one by one, a hunger strike has been ongoing since the PRD submitted documentation of anomalies in 53,000 out of the nation’s 130,000 polling places. Each night a different show business personality joins the fasters, eschews dinner and camps out in the guest pup tent overnight.

From Carlos Fuentes and Elena Poniatowska to painters like Jose Luis Cuevas and master designer Vicente Rojo, the arts and entertainment world has lined up behind Lopez Obrador. An exhibition by Cuevas and 50 other top line graphic artists and writers has been installed on the Alameda green strip adjacent to the Palace of Fine Arts here. After midnight, Calderon supporters slash and savage the art work, leaving a broken jumble behind.

The next day brigades of AMLO’s people from the surrounding neighborhoods rescue what they can of the exhibit, reassemble the broken shards, sew the torn art back together, and prop up the display panels. This is what democracy looks like in Mexico in the summer of 2006.

Act Four: Se Busca Por Fraude Electoral

The integrity of the Federal Electoral Commission is in the eye of Hurricane AMLO. Lopez Obrador accuses the IFE of fixing the election for Felipe Calderon and then defending his false victory. The PRD has filed criminal charges against the nine members of the IFE’s ruling council, most prominently its chairman, the gray-faced bureaucrat Luis Carlos Ugalde, for grievous acts of bias against Lopez Obrador, including refusing to halt Calderon’s hate spots in the run-up to July 2nd.

The IFE is mortally offended by the allegations that it has committed fraud and is using its enormously extravagant budget (larger than all of the government’s anti-poverty programs combined) to run spots protesting the slurs on its integrity that are every bit as virulent and ubiquitous as Calderon’s toxic hit pieces. Actors have been hired to impersonate irate citizens who allegedly were chosen at random as polling place workers July 2nd. “The votes have already been counted” they scoff. “We did not commit fraud” they insist. The idea is preposterous, an insult to their patriotism and to one of the pillars of Mexican “democracy,” the IFE.

Luis Carlos Ugalde, the president of the IFE council, has not been seen in public for several weeks except in large Wanted posters pasted to the walls of the inner city – SE BUSCA POR FRAUDE ELECTORAL! Ugalde and two other IFE counselors are protégés of powerful teachers union czar Elba Esther Gordillo, who joined forces with the PAN to take revenge on failed PRI presidential candidate Roberto Madrazo, a mortal enemy. The nine-member council is composed entirely of PRI and PAN nominees – the PRD is, of course, excluded.

Despite rumors that he had fled the country, Ugalde shows up July 27th at the first IFE meeting since the district tallies three weeks previous where he is confronted by the PRD delegate to the Institute (each party has one delegate.) During an acrimonious seven-hour meeting, Horacio Duarte keeps waving 30 partially burnt ballots, most of them marked for AMLO, that he has just been handed by an anonymous source. Duarte wants to know where Ugalde lives so he can nail one of the ballots to his front door to expose the “shame” of the fraud-marred election. The gray-faced bureaucrat grows even grayer and threatens to suspend the session. OK, OK, Duarte concedes, I’ll just hang it on your office door.

Just then a score of protestors push their way past the IFE guards at the auditorium’s portals – the meeting is a public one. They are chanting “Voto por Voto” and carrying bouquets of yellow flowers, AMLO’s colors. A PRD deputy tries to hand one to Luis Carlos Ugalde who turns away in horror. A bodyguard snatches up the blossoms as if they were a terrorist bomb, and disposes of them post-haste.

Act Five: We Shall Not Be Moved

The clock is ticking. The TRIFE must declare a new president by September 5th. The seven judges, all in the final year of their ten-year terms (three will move up to the Supreme Court in the next administration) have just begun to dig their way into the slagheap of legal challenges that impugn the results in about half of the 130,000 polling places in the land, the ham-handed bias of the IFE prior to the election, and the strange behavior of the Federal Electoral Institute’s computers on election day and thereafter.

The TRIFE, which has sometimes struck down corrupted state and local elections and ordered recounts in a handful of electoral districts, can either determine that the legal challenges would not affect enough votes to overturn the IFE’s determination that Calderon won the election, annul the entire election if it adjudges that it was illegitimately conducted, or order a recount. If the judges determine that annulment is the only way to fix the inequities, a new election would be scheduled 18 months down the pike.

In the meantime, the Mexican Congress would name an interim president, an unprecedented resolution in modern political history here – just the fact it is being discussed is, in itself, unprecedented.

Among those mentioned for the post are National Autonomous University rector Juan Ramon de la Fuente, former IFE director Jose Woldenberg, and three-time presidential loser Cuauhtemoc Cardenas, son of beloved depression-era president Lazaro Cardenas. For Cuauhtemoc, who was defrauded out of the presidency in 1988 by the same kind of flimflam with which the PAN and the IFE seek to despoil Lopez Obrador of victory in 2006, an interim presidency would be a perfect solution. Fixated on fulfilling the destiny of following in his father’s footsteps, moving back into his boyhood home Los Pinos – the Mexican White House – would be sweet revenge against his former protégé and now bitter rival on the left, Andres Manuel Lopez Obrador.

But AMLO does not want the election annulled and an interim appointed. He is obsessed with proving his triumph at the polls and is not going to sit on his hands waiting for the TRIFE to reach its learned conclusions. A gifted leader of street protest, he has summoned his people to the capitol’s Tiananmens-sized Zocalo square three times since July 2nd, each time doubling the numbers of the masses who march through the city: 500,000 on July 8th, 1.1 million on July 16th, and 2.4 million this past Sunday, July 30th (police estimates) – Sunday’s gathering was the largest political demonstration in the nation’s history.

The “informative assemblies” as AMLO tags them, have been festive occasions but underneath there is palpable anger. Lopez Obrador’s people come in family, arm babies and grandpas, often in wheelchairs are on canes. Some come costumed as clowns and pirates. dangling grotesque marionettes, lopsided home-made heads of Fe-Cal, or pushing a replica of the Trojan Horse (“El Cabellito Trojanito.”) They look like they are having fun but their frustrations can well up to the surface in a flash, say when the hated Televisa and TV Azteca appear on the scene. “QUE SE MUERE TELEVISA!” (THAT TELEVISA SHOULD DIE!), the people the color of the earth snarl and scream, pounding fiercely on the television conglomerate’s vehicles.

At the July 30th “informative assembly,” Lopez Obrador ups the ante considerably in his high stakes poker game to pry open the ballot boxes. Now instead of calling for yet another monster gathering in the Zocalo (4.8 million?), he asks all those who had come from the provinces and the lost cities that line this megalopolis to stay where they sre in permanent assembly until the TRIFE renders a decision. 47 encampments will be convened extending from the great plaza, through the old quarter, all the way to the ring road that circles the capital, snarling Mexico City’s already impenetrable traffic, raising the level of greenhouse gases and urban tempers to the point of combustion.

When Lopez Obrador calls for a vote on his proposal, 2,000,000 or so “SI’s” soared from the throats of the gargantuan throng, followed by the now obligatory roars of “No Estas Solo” (“you are not alone”) and “Voto by Voto, Casilla by Casilla.” As if on cue, AMLO’s people began assembling the encampments state by state and Mexico City neighborhood by neighborhood.

For a correspondent who once wrote a novel fictionalizing the stealing of the 1988 election (“Tonatiuh’s People,” Cinco Puntos Press, El Paso, 1999), in which the people the color of the earth march on Mexico City and vote to stay in permanent assembly in the Zocalo, fantasy has turned into the actualities of daily reporting. I am not surprised by this startling turn of events.

When I first arrived here in the old quarter days after the 8.2 earthquake that devastated this capital, the “damnificados” (refugees) were encamped in the streets, demanding relief and replacement housing and liberation from the ruling PRI and their movement from the bottom reinvigorated a civil society that today infuses AMLO’s struggle for electoral democracy. This morning, the damnificados of the PAN and the IFE, Calderon and the fat cats, are again living on these same streets.

On the first evening of the taking of Mexico City, AMLO spoke to thousands crowded into the Zocalo in a driving downpour and invoked Gandhi: “first they ignore you, then they laugh at you, then they beat you, and then you win.” And then Gabino Palomares, a troublemaking troubadour who has been up there on the stage at every watershed event in recent Mexican history from the slaughter of striking students at Tlatelolco (1968) to the Zapatistas’ March of the Those the Color of the Earth (2001) took the mic to lead the mob in that old labor anthem, “We Shall Not Be Moved” and AMLO’s people thundered back in a roar that drowned out the weeping sky, “NO NOS MOVERAN!”

Mandarin, though a Gen Xer by birth and a longtime resident of touristy Ghirardelli Square, still offers a matchlessly elegant experience in Chinese fine dining: a surprising number of genuinely spicy dishes, superior service, and wine emphasized over beer. MoMo’s San Francisco Grill The New American food at MoMo’s is surprisingly excellent, and the interior decoration is opulent, with prairie-style furniture, wood trim, dark green carpeting, and dimpled leather upholstery on the banquettes. Plouf Mussels 10 ways — need we say more? Plouf knows its turf, and that’s surf. All the seafood sparkles at this chic spot tucked away on pedestrians-only Belden Place, though mussels are a house specialty, impeccably fresh and served in brimming bowlfuls. All Lebanon is collateral damage

OPINION Once again, Lebanese civilians are getting blasted, killed, and bombed by high-tech American weapons because Israel is angry and lashing out. I remember this well; even some of the targets are the same. I spent part of my childhood in Beirut. I remember my mother yelling at me to get off the balcony where I was busy trying to see if it was an American F-4 Phantom Israeli Air Force jet or a French-made Dassault Mirage screaming by our apartment building at rooftop level on its way to bomb the Beirut airport yet again.
My mother wasn’t happy with my plane-spotting endeavors. But Beirut at the time was frequently called the Jewel of the Middle East, and I was lucky enough to go to the American elementary school. I remember Pigeon Rock, the cedars, the beaches — and the Israeli raids. In fact, such raids led to my family being evacuated from Lebanon on more than one occasion.
Whenever the Palestine Liberation Organization conducted a military engagement, US-supplied F-4 Phantoms would bomb the Beirut airport. It became almost a regular Sunday outing for Beirut residents. How many Middle East Airlines jets did Israel bomb today? If the Syrians lobbed shells or anybody else in the region displeased Israel, US-supplied F-4 Phantoms would bomb the Beirut airport. If there was a border incursion, US-supplied F-4 Phantoms would bomb the Beirut airport. Do you see a sadly familiar pattern?
The Lebanese are once again civilians paying for the actions of others. Lebanon is and always has been Israel’s whipping boy. It has become a pawn between Israel, Hezbollah, and possibly Iran. An entire nation is collateral damage. Two-year-old children dying with perforated eyes. Kids blown up when they go swimming in a canal. Are they any less innocent than the children killed in Hamas suicide bombings?
Believe it or not, your elected representatives care what you think, if you let them know in no uncertain terms. The United States supplies billions of dollars of no-strings-attached money to Israel. That money directly and indirectly supports Israel Defense Forces that have, in the last few days alone, killed more than 200 Lebanese citizens. Write your elected officials a personal letter. They pay attention to those. Demand that the United States stop funding Israel’s war — its terrorism with a bigger budget — on Lebanon.
The terror attacks on Israel are hideous, as is the region’s poisonous anti-Semitism. But so are Israel’s bombing raids that are destroying a recently revived Lebanon. Israel will not help its case with tit-for-tat attacks on civilians or the wholesale destruction of Lebanon’s infrastructure. The Germans’ bombing attacks on Britain in World War II didn’t break the people’s spirit and make them turn on Churchill; the opposite happened. One would think Israel might learn this lesson and act accordingly at the negotiating table.
War begets war, not peace. Write, don’t e-mail, don’t call — write a personal letter to your congressperson, your senator, your elected officials, demanding that the United States cut its military aid to Israel by half. That at least would get the Israelis’ attention off the bombs they’re dropping on the Lebanese and might even force Prime Minister Ehud Olmert to start negotiating for real. It would level the playing field just a bit. SFBG

Daly’s re-election

Pat Murphy at the Sentinel has a nice recap of a party for Chris Daly, sponsored by Jane Morrison and Agar Jaicks, who are longtime stalwarts of the local Democratic Party. Murphy reports on the usual plaudits from the likes of Tom Amminano and Aaron Peskin, who talked about Daly’s fighting spirit.

I missed the party, but let me add a point. Daly is a political pugilist, of course, and sometimes a bit prickly (he wouldn’t talk to me for weeks after we declined to endorse his Transbay Terminal proposal). But I watched a lot of the budget hearings, and I have to say: It’s not easy chairing that committee, and Daly did a really good job. When he’s not yelling at anyone, he’s actually a pretty fair legislator.

Healthy Compromises

Sup. Tom Ammiano and Mayor Gavin Newsom took another step today towards making health care accessible to all uninsured San Franciscans.
The San Francisco Health Care Security Ordinance, which Ammiano and Newsom announced their joint support for July 11, offers access to comprehensive medical services, while requiring that medium and large business meet minimum spending requirement on employees’ health care.
While the agreement is optimsitic, it wasn’t reached without compromise on the employer spending mandate.
From July ’07, when the ordinance would become law, until Jan. 2008, employers will have to provide healthcare for employees who work 12 hours or more. That requirement tightens to 10 and then 8 hours, in Jan. ’08 and Jan.’09, respectively.
Meanwhile, medium sized businesses, (20-50 employees) have until March 31 2007, to start making mandatory payments, (which amounts to about a $1 an hour per worker.
Other tweaks: employers won’t have to make health insurance payments, if their employee has coverage elsewhere (through a parent, a spouse, or presumably another job), but the employee decides who pays.
Of all three compromises, the 12-10-8 compromise spells the greatest danger for the local labor pol (what if stores cut workers’ hours to 11 each per week?)
A special Budget and Finance Committee meeting is set for Monday July 17 at 1pm, and the full Board will discuss it July 18, with a final vote expected on July 25.

Low-flying Seattle ethnomusic label Sublime Frequencies has been in business for less than three years, but in that time established itself as easily the most happening label around in terms of hard-to-find music from overseas. In fact, it’s created a niche that didn’t even really exist before, steadily churning out kaleidoscopic and often in-your-face CDs and DVDs from places as far flung as Iraq, Java, North Korea, and Nepal, releases that are equally at home in the world music and experimental sections at a record store.
I don’t love everything they’ve put out, but I have listened to every note of the more than 20 CDs released so far — I’ve missed a few DVDs, I admit — and a handful of them have become personal favorites. Another half dozen have landed in heavy rotation on the home stereo at various points. I’ve especially enjoyed the label’s presentation of music from Southeast Asia, including two discs compiled by Bay Area musician Mark Gergis of Porest and Neung Phak — Molam: Thai Country Groove From Isan and Cambodian Cassette Archives: Khmer Folk and Pop Music Vol. 1 — and several more assembled by label head Alan Bishop of the Sun City Girls, including the frantic Radio Phnom Penh and last fall’s unstoppable Guitars of the Golden Triangle: Folk and Pop Music of Myanmar Vol. 2. The massive amount of material the pair cull from radio, vinyl, cassettes, and field recordings is beyond the reach of most file sharers because the majority would have no idea where to start downloading, and Gergis and Bishop put out their findings without much information or regard for sound quality or marketability. What I like about the music on these discs is the blend of familiarity and strangeness, of traditional and modern influences.
The latest batch from Sublime Frequencies unleashes music from Algeria and Northeast Cambodia, as well as a couple of new ones from Thailand: a two-CD set titled Radio Thailand: Transmissions from the Tropical Kingdom and a DVD, Phi Ta Khan: Ghosts of Isan. Radio Thailand was compiled by Gergis and Bishop, who each produced a disc, and like all the label’s Radio titles, it is a fast-paced collage of music, advertisements, and news snippets spliced together from hours of radio broadcast recordings. Segues are abrupt at times, and the fidelity varies wildly. While the experience as a whole is like watching TV while someone else is wielding the remote, at least the content is more interesting than flipping between, say, VH1, Court TV, and lame reality shows.
Listening to Radio Thailand’s second disc, I’m struck by the futility of trying to describe this music in any sort of useful detail. I don’t know the artists’ names, the song titles, or the years any of the music was released. I can’t understand the lyrics and don’t know the names of most of the genres or subgenres represented. Now and then a familiar snippet pops up, like the tune from Ennio Morricone’s theme to For a Few Dollars More — only it’s dressed up in low-budget ’80s synth tones and slapped on top of a disco beat with a guy singing a completely unrelated melody during the verses. There are syrupy ballads, droning a cappella chants, and lots of bouncy ’80s synth pop that sounds absolutely nothing like New Order. Now and then, a voice in English emerges from the wilderness, but it’s inevitably a non sequitur: an announcement for a giant catfish fry, a report on the quality of Thai rubber, a woman announcing, “I have 20 minutes left with you guys, at least. Like, 22 minutes. No, 21 minutes and something.” Unless you’ve been to Thailand and spent hours flipping through the radio dial — and I certainly haven’t — then you probably haven’t heard anything like this.
In contrast to the information onslaught of Radio Thailand, the recent DVD Phi Ta Khan: Ghosts of Isan is far more deliberate in its pacing. Produced by Rob Millis of the Seattle group Climax Golden Twins, the video documents a three-day festival in the northern Thai region of Isan, near the border with Laos. This region is the home of the hypnotic, droning molam style featured on the aforementioned Thai Country Groove CD, and there’s plenty of that music to be heard here. There’s zero narration and Millis doesn’t employ any fancy production tricks, but none of that is needed, as the costumes, dancing, and music are colorful enough on their own. In addition to the religious-occult focus of the festival, there’s also apparently a fertility ritual at work, judging by the vast assortment of phallic symbols on hand: handheld penises, wooden penis puppets with movable parts, you name it. One particularly bizarre scene involves two men trying to repair the damaged member belonging to one of the giant costumed mascots.
The incredible music here ranges from giant percussion ensembles composed of ordinary villagers to full-on electrified combos rolling down the street on the back of flatbed trucks equipped with generators and huge stacks of speakers. At one point, a nasty fuzz-tone keyboard sound surfaces amid the din, but before you can ask, “Where did that come from?” it turns out to be nothing but a Casio being run through a couple of battered PA cones on the back of a moving pickup truck. This scene, like the entire DVD, embodies the sort of low-budget mayhem at the heart of the label’s seat-of-the-pants aesthetic. You won’t find this stuff at Starbucks. SFBG

Prop. A reality check

The greatest irony of Proposition A’s failure last month seemed to be what took place just a few short weeks after the June 6 election.
Prop. A would have budgeted $30 million over the next three years to fund violence prevention services for at-risk populations, such as anxious teens looking for a break from order during the warm summer months. It was a clear response to the city’s headline-grabbing homicide rate, which has continued its stubborn ascent this year, making life politically difficult for Mayor Gavin Newsom, District Attorney Kamala Harris, and the Police Department.
But with the mayor and the cops in opposition, the measure lost by less than a single percentage point. And just two weeks later, 22-year-old Andrew Ele — known among his friends as DJ Domino — was shot and killed at a bus stop near 24th Street and Folsom. Ele was a regular teen-outreach volunteer at Coleman Advocates for Children and Youth, a San Francisco nonprofit that helped run the Prop. A campaign with Sup. Chris Daly.
On June 20, as Ele waited for a bus with his brother André, a gunman walked to the middle of 24th Street and fired several shots at each of them before escaping in a waiting white Mazda MPV, the Police Department told the Guardian. André survived with non-life-threatening injuries, but Andrew was pronounced dead at the hospital.
The police still don’t know who killed Andrew, but as we’ve reported previously, the department hasn’t had the best luck with recent homicide investigations. As of January 2006 police had made arrests in fewer than 20 percent of the homicide cases that were opened the previous year, and the district attorney’s office has managed to file charges in only a fraction of those cases.
BACK TO THE BUDGET
The day after the election, the San Francisco Chronicle framed Prop. A’s failure as a big political win for Newsom rather than what it really was: an enormous letdown for groups such as Coleman Advocates that are offering something other than increased law enforcement. The $30 million may not have immediately improved DJ Domino’s chances of remaining alive, but neither did $18 million the city paid police overtime last year prevent a Mission bus stop from being filled with bullet holes.
The issue of violence prevention is still alive, though, and it surfaced again during the recent budget negotiations.
The press release accompanying the mayor’s late-May budget proposal for the next fiscal year boasts that Newsom set aside $2.7 million for violence prevention and intervention, which he combines with $7 million the board supplemented for the current fiscal year. Featured more prominently in the press release is his bid for 250 new cops — and yet more money to pay them overtime.
However, the board’s budget committee, chaired by Daly, found $4 million more for violence prevention, including $1 million to save the Trauma Recovery Center, which assists victims of violent crime and was close to shutting down in November for lack of funds. Not to be outdone, the mayor unveiled “SF Safe Summer 2006” last week, just as the Guardian was putting together this story, which includes an expansion of the Community Response Network, a Police Department program.
The budgetary give-and-take reflects the city’s growing frustration over a homicide rate that has at times resulted in tense Police Commission meetings. Last month a meeting at the Ella Hill Hutch Community Center — held the day after Prop. A failed — was commandeered by Western Addition and Bayview–Hunters Point residents angry over a perceived failure by the city to respond to chronic gang and street violence. (Police Chief Heather Fong and Sup. Sophie Maxwell were literally shouted down at the meeting.)
The campaign for Prop. A forced the city to address its ongoing philosophical divide on how to face off against violence. More cops or more outreach? More patrols or more job training? More overtime or more murals?
“Their approach is suppression,” Coleman Advocates youth coordinator José Luis said of law enforcement. “They get rats; they send in informants. They don’t want to use prevention.”
Luis knew Ele for eight years and said the latter used to help provide security at drug- and alcohol-free hip-hop shows that cops in the Mission eventually stopped.
“[Ele] on countless occasions jumped into a brawl and stuck his neck out to stop it,” Luis said of the events.
Ele, who often performed at clubs in the city with the DJ troupe Urban Royalties, had big plans for his life. He was going to record an album at CELLspace in the Mission once construction of a recording studio was completed there. Then he’d planned to teach young people how to spin and record hip-hop themselves.
THE OTHER APPROACH
CELLspace is a 10,000 square foot warehouse on Bryant Street that has for the last several years served mostly as an outpost for industrial artists. Locals know it best for the acrylic bombs that cover its exterior honoring fallen graf heads and Mexican revolutionaries. The building hosted dance parties for teens in the ’90s, but they were eventually shut down by the city.
By 2003, however, CELLspace had recharged its outreach efforts, slowly building an administrative staff, acquiring grant money, and implementing new after-school programs. Staffers are working with ex–gang members and specifically targeting recent Latino immigrants, who are often recruited by gangs.
“Those of us who sort of grew up in street culture, we have more experience with what could work now,” said CELLspace’s 25-year-old executive director, Zoe Garvin, who was born and raised in the Mission.
The place is brimming with ideas. There’s talk of outfitting a low-rider car with a biofuel engine and solar-powered hydraulic suspension. Staffers are building low-rider bikes and collaborating with other Mission-based groups to teach kids screen printing and break dancing. They even have a class for skaters, but the ramps that quietly appeared a couple of months ago at the Mission Flea Market, across Florida Street on the west side of the warehouse, will soon have to make way for a moderate-income housing complex, Garvin said.
CELLspace, she said, would have applied for Prop. A funding, but is looking elsewhere now. The Mayor’s Office of Criminal Justice in early July passed over their $600,000 grant application, which would have funded a street outreach and case management program for 18- to 24-year-olds.
“I think we’ve done a really good job creating a sanctuary in here,” she said. “You have to be careful how you do it. You can’t just hire anyone.”
While the city eventually found money for community-based organizations through the budget process, it’s doubtful the debate over how to take on street violence issues will cease.

Amalgamated health care

Mayor Gavin Newsom has taken credit and sought the national spotlight for a plan he touts as an innovative way to deliver universal health care access to the city’s uninsured. Yet Newsom has consistently ducked the vitriolic public debate over how to the pay for the plan, which a companion measure by Sup. Tom Ammiano would cover with a controversial employer mandate.
But as the measures were headed for the first of at least two hearings before the Board of Supervisors (on July 11 after Guardian press time), a board committee and Newsom’s public health director, Dr. Mitch Katz, finally made it clear that Newsom’s plan can’t stand alone, as much as the business community would like it to.
“The two pieces of legislation were created to and do fit together,” Katz said at a July 5 Board of Supervisors’ Budget and Finance Committee hearing. “One can’t successfully move forward without the other.”
Katz made the comments after budget analyst Harvey Rose said the mayor’s plan doesn’t contain a specific funding mechanism. Rose’s admission prompted Sup. Ross Mirkarimi to characterize the mayor’s proposal as “a one-winged aircraft that doesn’t fly.” Sup. Chris Daly added that “It’s time to be up front that [the San Francisco Health Access Plan] only works if it has significant contributions from outside sources, including Ammiano’s plan.”
Neither Newsom nor his spokesman Peter Ragone returned repeated calls for comment on the issue. The Mayor’s Office also has not fulfilled a June 22 request by the Guardian for public records associated with the plan in violation of deadlines set by the city’s Sunshine Ordinance.
“Celebrating one resolution while pooh-poohing the other is disingenuous, because if they don’t work together, nothing works,” Mirkarimi added at the hearing, shortly before he, Daly, and a mostly mute Sup. Bevan Dufty voted to combine both proposals into one health care plan: the San Francisco Health Care Security Ordinance.
“After today’s meeting,” Ammiano wrote in a follow-up press release, “I’m confident that the citizens of San Francisco and the media will understand that the Worker Health Care Security Ordinance and the Health Access Program are one comprehensive health care plan, and are now codified as such in a single bill.”
The decision to amalgamate left small business owners voicing fears over the economic impact of the employer spending mandate, which would raise an estimated $30 million to $49 million of the $200 million cost of providing health care access for San Francisco’s uninsured.
As the controller’s Office of Economic Analysis points out, most of the financial burden of the employer mandate “falls on businesses with 20 to 49 employees, since these firms currently are less likely to offer health care benefits to their workers.”
With the cost of covering 20 full-time employees’ health care estimated at $43,000 to $65,000, many business owners fear the mandate will result in layoffs, economic downturns, and the erosion of their already marginal profits.
Although the controller predicts a “nearly neutral impact” on the city’s economic picture — a loss of 60 to 590 jobs from staff cuts or business closures mitigated by 140 to 250 new health care–related positions — small businesses worry about the controller’s “moderately adverse impact” prediction for employers who currently aren’t offering health care benefits at mandated levels.
“It’s going to add another $50,000 to my already high health care costs,” John Low, who runs a small company in the Tenderloin, said at the hearing. San Francisco Soup Company owner Steve Sarver claimed the mandate could force him to abandon expansion and hiring plans: “Projects that I was borderline on, I’m now going to go toward eliminating those jobs.”
As written before the July 11 hearings, the mandate would kick in January 2007 for large businesses and the following January for small businesses. Mirkarimi says the board should be “extremely sensitive” to the small business community’s concerns.
“The business community knows best how to speak about profit margins. Right now, an employer spending mandate is the only option in orbit. If there are other options, great, but so far all we’re hearing is nothing but distortion,” Mirkarimi told the Guardian. He said the proposal by some downtown leaders to increase the sales tax by a half cent — an alternative to Ammiano’s mandate — comes from “the same community who would sabotage any attempt to enact a tax-based funding mechanism.”
Mirkarimi told us the mayor’s plan was “prematurely pitched through the media on a national stage,” while Ammiano’s legislation, “which is really the heart and soul of the plan, has struggled to get any notoriety locally.” Mirkarimi told us he hopes Newsom will directly address small business concerns — including the reality that his health access plan can’t work without Ammiano’s mandate.
“The mayor needs to make an effort to show small business that he intends to mitigate the negative financial side effects of his plan. But what is the mayor’s communication? And why is he relying on the Board of Supes to fill in the blanks? The mayor needs to exercise leadership, to admit that for his plan to work somebody has to pay, and decide who that somebody is going to be, then build confidence that he has adequate answers. But right now, he’s deflecting that responsibility onto the board.”
Dr. Katz, who was a member of the Universal Healthcare Council that created the plan to offer health access to all the city’s uninsured residents, said he neither hopes nor believes that all 82,000 of the city’s uninsured will enroll.
“We hope that large employers continue to chose commercial health insurance,” Katz said at the meeting, noting that 95 percent of businesses with more than 100 employees already have commercial health insurance.
“If people enroll in a commercial health insurance plan, the city doesn’t get the revenue, but we also don’t get costs,” said Katz, who believes the city can offer health access to all uninsured residents without building additional health centers.
“All existing clinics and facilities have shown a desire to join the program and accept people,” Katz said, noting that the $104 million the city already spends on San Francisco’s uninsured is on the lowest-income individuals, plus a minute subsidy to small- and medium-size business but no subsidy for large businesses.
“Most of SF’s 82,000 uninsured residents are getting care right now, but not in a rational way,” Katz explained. “I look at how much capacity could we add to health centers by only paying for additional providers, like nurses, doctors. And the answer is a lot. We’re not doing evenings or Saturdays, so we just need to open for more hours and hire more doctors, nurses.”
Acknowledging that the Department of Public Health already saw 49,000 uninsured residents last year, Katz said that doesn’t mean that people are getting what he calls “rational care.”
“So when we create a system, we’ll create a demand,” he said. “It’s not just the woman with a bad cough who comes in, but now she’ll also get a pap smear.” SFBG

CULT MOVIE It’s finally here. Beyond the Valley of the Dolls (Fox Home Entertainment), a top contender in my sordid little mind for the greatest movie ever made (next time you see me in a bar and have two or three hours to kill, I can give you the complete list) has arrived in splendid, special-edition DVD form. Has Hollywood ever been so satirically skewered? Has a single film ever crammed in so many genres — musical, comedy, melodrama, youth-gone-wild, slasher? Has the Bentley vs. Rolls sex question ever been so definitively answered?
From its opening, mind-blowing tease to its hilariously somber coda, Russ Meyer’s brilliantly colored, brilliantly bizarre 1970 classic (scripted by Roger Ebert, it was Meyer’s first major-studio release) stands well enough on its own. But in this two-disc package you also get commentaries (one by Ebert, one by cast members); a giddy making-of doc; featurettes spotlighting the film’s rockin’ tunes, groovy dialogue, and more; and screen tests featuring future Carrie Nation members Cynthia Meyers (Casey) and Marcia McBroom (Pet).
But it gets better, superwoman. This week, pry your sweaty claws off your BVD DVD and look on up at Peaches Christ, who’ll be hosting a reunion of stars McBroom, Erica Gavin (Roxanne), and John La Zar (Ronnie “Z-Man” Barzell). Midnight Mass unspools two nights of gentle people and mayonnaise on the big screen, and the cast — currently on a mini–promo tour that also includes stops in Austin, Los Angeles, and Phoenix — will descend on Amoeba with Peaches for a DVD signing.
“This is gonna be so much fun for me,” La Zar enthuses over the phone from LA. “San Francisco is my hometown — I was raised in the Richmond District, 36th Avenue right off Fulton. This will be the first time I’ve worked in San Francisco since [I performed with] American Conservatory Theater in 1967.”
Cast as the Phil Spector–ish, flowery-tongued Z-Man after he was spotted by 20th Century Fox scouts doing a play in Hawaii (“They needed a young man who could do kind of a weird classical thing”), La Zar isn’t surprised BVD has enthralled a new generation of fans. “It’s a youth film, isn’t it — there’s still a rebelliousness to it.”
La Zar reveals he wasn’t initially fond of the film’s most memorable line — “This is my happening, and it freaks me out!” — later aped in the Ghost World comic and by Austin Powers, among others. “I thought the line sucked, but Russ Meyer shamed me into it. He said, ‘You’re an actor, aren’t you?’ And lo and behold, that’s what I’m most famous for in the film!”
Prior to BVD, Hollywood native Gavin starred in Meyer’s 1968 smash, Vixen! “I was much smaller than most of his women, but he figured maybe women could relate to me better,” Gavin says, speaking from her SoCal home about the famously breast-obsessed director, whom she recalls with great fondness. “He was a big teddy bear — tough on the outside and mushy on the inside.”
Gavin, who’s thrilled that BVD is receiving such grand DVD treatment, remembers how excited Meyer was while making the film. “The budget was huge for him. He was like a babe in toyland — he had all these resources at his fingertips.”
The film has endured, she thinks, because of its humor. “It’s almost like, no matter what generation, it’s so silly — almost like The Rocky Horror Picture Show or Spinal Tap. It’s not a comment on today, or life as it is. It’s really life as it isn’t. It’s cuckoo!” (Cheryl Eddy)

The Wolf that Peter built

Prohibition saw the blossoming of alcoholic communing. Antismoking laws brought smokers closer together. So what about this musical wolf craze, Wolfmothers and Wolfkings, the endless urge to shape-shift? We’re becoming more human.
Note the outpouring of pop collectives that are truly collective. Observe Austin, Texas’s Peter and the Wolf, Red Hunter’s experimental folk project, whose acoustic performances in graveyards, in abandoned buses, even on an island, have put them on the map. For the island gig, Hunter said, speaking from his hometown the day before his current tour began, “People rowed out! We’re not trying to get back to nature; we’re just all about finding weird places to play.”
On the East Coast, Hunter will be joined by Jana Hunter — no relation — and the Castanets for a tour via sailboat. Originally just “bar talk” about alternative-energy means of touring, the sailboat is now ready and willing. The quest for “polypropylene Bermuda shorts” has trumped other logistical concerns.
On Peter and the Wolf (Whiskey and Apples), Dana Falconberry adds an angelic vocal counterpart to Hunter’s raw folk sound. Imagine the Ditty Bops — who’ve been touring by bicycle — without the in-your-face theatricality. Each acoustic, indie-loungey tune on Peter and the Wolf is punctuated like a single snippet of conversation. In “How I Wish,” the duo beckons, “Meet me on the wooden bridge/We will smoke and then we’ll wander.” In the postbeat dreamscape “What Happened Up There …,” past lives mingle with present lusts.
In Scotland, I drank surprisingly trippy alcoholic homebrew, a friend’s Irish family recipe. Moonshine. Hooch. Stumpblaster. Whatever, man, if we’re on the road to ruin, we might as well see it up close and personal. For Hunter and his hunters this summer, every campfire is a carnival waiting to happen. When, someday, we finally tell our stories, he predicts on the animistic “The Fall,” we will be gloriously “Desperate and serious/The chasing will be furious.”
Apocalypses aside, everyone’s talking about two things these days: the energy crisis and Matthew Barney’s annoying insistence on big-budget “restraint.” Well, Prokofiev probably wouldn’t have produced his every-instrument-is-an-animal Peter and the Wolf without Stalin’s caustic commie prodding. But Hunter needs no such restriction. His energy leaps through the seams. “Do you think of me when he’s boring you/I’ll bet you do,” he sings on “Silent Movies.” Now that’s a man I can believe in. Just a few summers ago, we were all snickering into our popcorn tubs: a Pirates of the Caribbean movie? Yo-ho-no! But what could’ve sucked harder than The Haunted Mansion turned into a monster 2003 hit, buoyed by ghostly buccaneers, showy effects, and Johnny Depp’s impeccably bizarre turn as Captain Jack Sparrow, surely the most inventive character yet to emerge from a 21st-century blockbuster. Long before Depp’s Oscar nomination, plans were afoot to increase Pirates of the Caribbean: The Curse of the Black Pearl’s bootylicious haul with a pair of sequels filmed back-to-back. So, how can you love a series based on a rather sedate Disneyland attraction — films accompanied by a merch deluge not seen since fanboys were still jazzed about gettin’ to know Darth Maul?
Pretty much, it’s the pirates. Peg legs, cannon battles, talking parrots, mutiny on the high seas, rum chugging — pirate shit is damn near irresistible, especially when Depp’s riding the mast. Within the first reel of Pirates of the Caribbean: Dead Man’s Chest, a chorus of arrrs is raised, a mangy bird plucks out some poor soul’s rotting eyeball, and a crew member remarks that Captain Sparrow is acting “strange … er” than usual. Chest’s plot is more convoluted than Pearl’s, but every character — including Sparrow, feisty Elizabeth (Keira Knightley), heroic Will (Orlando Bloom), and prissy Lord Beckett (Tom Hollander) — is searching for someone, or something, with single-minded determination. Chest also shares Pearl’s ticking-clock pacing, with lives and relationships and eternal souls hanging perilously in the balance. Naturally, all these quests become interwoven and complicated by distractions, including a detour to a Skull Island–meets–Joe Versus the Volcano atoll, a gung ho swordfight, a beast bearing giant and aggressive tentacles, and the salty whims of Davy Jones (Bill Nighy), whose ghostly Flying Dutchman operates like a kelp-strewn variation on the Philadelphia Experiment.
Unlike, say, flicks based on beloved comic books, Chest has no touchstones to hit or homages to pay, other than dropping in a few references to the first film. This allows director Gore Verbinski and scripters Ted Elliott and Terry Rossio (like sultan-of-slick producer Jerry Bruckheimer, all back from Pearl) the freedom to toss whatever they want into their Chest, which runs almost as long as Superman Returns but is infinitely more jolly, Roger. For a big-budget studio confection, there’s actually a lot of imagination at play; Nighy’s sneering performance, coupled with the special effects used to create Davy “Fishface” Jones’s slimy visage, allows for a character who’s equal parts Phantom of the Opera and Sigmund and the Sea Monsters.
Of course the main reason the Pirates movies are so fun is Depp, without whom we’d be talking about a few hours of flashy CG and a couple of pretty faces (Bloom, you’re still on notice for Elizabethtown). Sparrow prances, turns tail, delivers flowery double-talk, and cares only about saving his own skin (and, of course, his precious hat) — yes, he’s a showboaty clown, but Depp manages to make him likable where others (Jim Carrey?) would simply come up annoying. I’m still not sold on Depp’s Willy Wonka interpretation. But it’s with good reason that Sparrow’s the only film character he’s played more than once.
And he’ll play him again, to be sure. It’s not spoiling anything to say that Chest ends with classic middle-film-of-a-trilogy ambiguity; fates and loyalties wind up shakier than the points on Sparrow’s discombobulated compass. The third Pirates is due next summer, so you won’t have long to wait to see what happens. In the meantime, Chest is a solid adventure with a sense of adventure — cinematic currency that’s as good as gold these days, ye scurvy dog. SFBG

The best health care plan

EDITORIAL The health care model that’s been established, largely by default, in the United States is an utter mess. Most working people get their insurance through their employers. That means people who have jobs that don’t provide insurance are out of luck, and people who don’t have jobs are out of luck, and the self-employed are stuck with crazy bills, and small businesses are getting hit harder and harder with rising insurance rates that they can’t afford.
It’s a ridiculous way to handle health care: In most other western democracies, everyone is part of a national health care program, and under the best systems, the government is the single insurer and pays all the bills.
Among other things, that prevents the sort of crisis that San Francisco faces today, where the large numbers of uninsured residents have no choice but to seek care at the overburdened San Francisco General Hospital. That leaves the taxpayers on the hook for more than $100 million a year.
For businesses, particularly small businesses, that scrape and suffer to provide health insurance for their workers, the system is fundamentally unfair: Those companies pay twice, first for their own employees, and then again in higher taxes to cover the costs of the uninsured. Businesses that can well afford health insurance (the Wal-Marts of the world) but don’t pay are forcing others to cover their costs.
In a perfect world, with national health insurance, this wouldn’t be an issue. But it’s almost impossible for a single city to implement a single-payer system — which is why Mayor Gavin Newsom is struggling to present a functional health plan, and why Sup. Tom Ammiano’s employer mandate plan is absolutely necessary.
But the small business advocates who complain about the burden of paying more than $100 a month for each uninsured employee have a point, too — and this entire plan ought to be linked (at least in the long run) to Sup. Aaron Peskin’s proposals to change the city’s business tax.
Newsom’s dramatic announcement last week of a complex plan to cover all residents won overwhelmingly favorable press coverage. But so far, the plan itself is little more than a glorified press release. There are a lot of devilish details, particularly when it comes to funding.
There’s no new money in the mayor’s plan. He argues, correctly, that San Francisco currently spends $104 million on health care for the city’s 82,000 uninsured, and shifting that money into a city-run health care program will underwrite a significant amount of the cost. But that money can’t just be moved like a chess piece — it’s part of the San Francisco Department of Public Health budget, and if everyone does not sign up for the new program and very sick patients (including, say, undocumented workers who don’t understand or fear enrolling in the city plan) keep showing up at General, there won’t be enough money to go around.
There’s also the very real prospect that some unscrupulous employers will simply quit paying health insurance premiums and dump their employees into the city plan. That would overwhelm the program and push it quickly toward financial ruin.
So the mayor’s plan has no chance at success unless Ammiano’s employer mandate passes, too. The Ammiano plan would offer additional funding for the program by requiring that employers either provide private health insurance or pay into a city pool — and would prevent businesses from tossing their health expenses into the city’s lap.
Ammiano’s plan isn’t perfect — no employer-based plan ever will be. The health insurance requirement would hit all businesses with more than 20 employees, and that might be a bit low. The plan already has some progressive gradations (companies with more than 100 employees would pay a higher fee), but linking the costs more directly to the size of the business (in other words, hitting the large outfits — which can well afford health insurance — a bit harder and giving more of a city subsidy to the smallest companies) could help ease the burden on struggling merchants.
But in the end, his plan — which would have no impact on employers who already offer health insurance to their workers — is crucial to any effort to get the uninsured into a decent health program (and to end the stiff taxpayer subsidy for companies that don’t provide insurance). The supervisors should approve it.
Still that’s not the end of the story. At the same time that Ammiano’s addressing health care, Peskin has floated a proposal for a new gross receipts tax on local business. Here’s the way to proceed: The supervisors need to fund a complete study of how much gross revenue local firms take in; write a new tax that allows the city to eliminate the payroll tax; add a progressive gross receipts tax; and use the next tax policy to help deal with the costs of health care. Big, rich companies pay a lot (enough to help subsidize the citywide health plan). Small firms pay less (and the reduced tax burden helps offset the costs of paying for health insurance). In the end, San Francisco would be the first US city to launch a progressive system for providing health insurance to all. SFBG

How to end the violence

OPINION Despite its loss at the polls earlier this month, the spirit of Proposition A, the homicide prevention charter amendment on the June 6 ballot, lives on. Prop. A would have mandated that the city invest $10 million in violence prevention efforts. Instead of the typical police response to violence, Prop. A sought to address the root causes of violence, the social isolation and limited opportunity that are so endemic to the neighborhoods most impacted by street violence.
Prop. A offered a menu of strategies, including community outreach and organizing, job training and job creation, and reentry services so that ex-offenders have more than a couple hundred dollars in their hands when they leave prison. It was clear to everyone involved in the Prop. A campaign that this was about ameliorating the harmful effects of poverty and racism.
Even before the election, Prop. A was having an effect. Just two months after saying that no further investment was necessary to stem the tide of violence, Mayor Gavin Newsom crafted an ordinance with Sup. Fiona Ma to increase funding for violence prevention efforts. Responding to community groups, the Board of Supervisors stripped from the original Ma-Newsom legislation a bunch of police department goodies, including a ropes course, surveillance cameras, and bookmobiles — and beefed up the provisions on jobs and workforce training and added school-based violence prevention efforts, street outreach programs, and reentry services.
Overall the Board of Supervisors invested close to $6.9 million in programs and services. That’s a great initial investment but not enough, especially when a significant portion of the new funds can only be used for people under the age of 18.
The budget process offers the opportunity to serve the 18-and-older population and build on the foundation set earlier this spring. To this end, the budget committee added back over a million dollars to save San Francisco’s Trauma Recovery Center for the victims of violence and sexual assault. Now as a result of great advocacy from the violence prevention community and some unprecedented collaboration between the district attorney, the public defender, and the sheriff, the budget committee can program outside the box.
Before the committee Thursday, June 29, will be proposals to increase street-violence prevention outreach efforts, wraparound case management for victims at San Francisco General Hospital, housing relocation services for families impacted by violence, and reentry programs for ex-offenders. All of these programs can be part of a national model for other cities to emulate.
Contrary to the mayor’s line that the city does not need to contribute more resources to violence prevention, I believe city-sponsored resources make a dramatic change in how people caught up in all sides of the epidemic can have better choices and a dignified way out of these mean streets.
Violence is solvable if we make the right choices. SFBG

Mayor Gavin Newsom has garnered media accolades for his San Francisco Health Access Plan, which would provide the city’s 82,000 uninsured residents a package of health care services, including preventative, primary, specialty, and emergency care, lab work, X-rays, pharmaceuticals, and inpatient hospitalization.
All of this sounds good until you consider how the press has glossed over serious flaws in Newsom’s plan, which was coauthored by Sup. Tom Ammiano. And SFHAP could be doomed to fail unless coupled with the more controversial Ammiano-authored health care legislation: the Worker Health Care Security Ordinance (WHSCO).
Ammiano’s ordinance would require employers operating within the city that have at least 20 employees (or 50 employees for nonprofits) to provide health care coverage for their workers. Predictably these mandatory spending requirements have the business community screaming its opposition — and Newsom, who is up for reelection next year, pussyfooting around the issue.
But the truth is that Newsom hasn’t detailed how to fully pay for his plan or avoid its policy pitfalls without the financial and structural boost that WHSCO’s mandates provide.
“There is no separation between the two pieces of legislation except in the way they’ve been presented. They’re joined at the hip, and there will be no funding gap with both pieces of legislation working together,” Ammiano told the Guardian.
Here’s how the plans work: To cover the estimated $200 million cost of Newsom’s sliding scale SFHAP, the city would contribute the $104 million it currently spends on the uninsured, hoping that more preventive care would efficiently translate into lower emergency room costs.
Add that to an estimated $60 million that the city thinks higher income enrollees will pay, plus an additional $10 million in estimated savings from increased federal cost-sharing. But even if all that works out, there’s a $30 million shortfall.
Enter Ammiano’s plan, which would generate an estimated $30 million to $40 million in employer contributions. There’s also another key piece of Ammiano’s plan that saves the one Newsom is touting: Unless Ammiano’s plan becomes law, there’s nothing to stop employers who already offer health insurance from saving money by dumping their workers into Newsom’s newly minted program, thus expanding the number of uninsured and potentially overwhelming the city’s clinics.
While Ammiano’s plan requires businesses with more than 20 employees to cover 50 percent of workers’ health care costs ($1.06 an hour), and those with more than 100 employees to cover 75 percent of those costs ($1.60 an hour), it also offers employers a wide array of health care expenditure options, including providing insurance, creating health savings accounts, or paying into the Health Access Plan.
There’s a reason for these options: the federal Employee Retirement Income Security Act. The act prevents cities and states from specifying which health care plan employers must provide. But as Ammiano discovered, municipalities can stipulate how much employers must spend on health care.
Asked why he thinks Newsom isn’t giving Ammiano’s mandatory plan his public blessing, Ammiano waxes diplomatic.
“I asked the mayor, ‘So, what could you live with?’ and the answer was the Health Access Plan, in which everyone is covered, and there are no preexisting conditions,” Ammiano told us.
But the business community latched onto the idea as if it existed in a vacuum. Nathan Nayman of Committee on Jobs helped develop the Newsom plan but continues to slam Ammiano’s ordinance. At a Budget and Finance Committee hearing on June 26, Nayman called Ammiano’s ordinance “a full frontal assault on small and medium businesses.” But when challenged by Sup. Ross Mirkarimi over how killing the ordinance would incapacitate Newsom’s plan, Nayman suggested “putting both plans on hiatus.”
Ammiano said he’s running out of patience with Nayman and his downtown allies.
“They didn’t lift a finger except to come in at the last minute with a proposal that was neither progressive nor legally viable,” he complained, referring to an 11th-hour suggestion that businesses be charged a license fee. The fee would have fallen heavily on businesses with less than 20 employees — which don’t have to provide health insurance — and likely would have been challenged as a tax in disguise, thereby triggering a ballot.
Not that the Ammiano camp is afraid of voters. In 2004, 69 percent of San Francisco voted for Proposition 72, which would have provided employer mandated health care had it not narrowly failed statewide. So while Ammiano anticipates resistance from the business community, he isn’t expecting a “monolithic rebellion.”
“They’ve been doing their own polling, so they know if [mandatory health care spending] goes to ballot, it’ll pass, and they’ll only get much more rigid legislation,” Ammiano told us.
Ken Jacobs, who Ammiano describes as the brains behind WHSCO and who was also part of the mayor’s 37-member Universal Healthcare Council that developed SFHAP, told us WHSCO not only helps workers who don’t have health care access but also serves to stop the erosion of employer-sponsored coverage.
Jacobs — who is deputy chair of UC Berkeley’s Labor Center — said it’s important not to erode the 85 percent of SF-based businesses already providing employee health care benefits. Even Newsom’s health director, Mitch Katz, has publicly said that good health insurance is better than the access plan Newsom is touting.
Crediting San Francisco’s existing clinic system for making SFHAP conceptually possible, Jacobs noted that its estimated $200 million annual cost is based on “a fully ramped-up program in which every uninsured resident is enrolled” — something he believes won’t happen immediately.
Jacobs also points out that if employers who currently don’t offer medical benefits sign up for private insurance because of WHSCO’s mandate, their employees will no longer be uninsured, thus reducing the public system costs. He also believes that because WHSCO makes large employers spend $274 a month, it’s unlikely they’d opt for SFHAP because that plan is limited to care in San Francisco.
Conversely, SFHAP requires participants to be willing to apply for state and federal benefits. They also must pay monthly fees ranging from a nominal $3 for those earning below $19,600 to $35 for those earning between $19,600 and $40,000 to $201 a month for those earning over $50,000.
There’s also one more reason why Newsom will likely to be forced to accept the marriage with Ammiano’s plan, despite the grumbling from his business community supporters: Eight supervisors have now signed on as WHSCO cosponsors, giving it a veto-proof majority.
Newsom’s spokespeople did not return our repeated calls for comment, but Eileen Shields of the Department of Health confirmed that “Ammiano’s legislation supports making the SFHAP a reality financially.” SFBG

Mr. Big Stuff

America is unquestionably the land of the large. We well realize that gigantic things generate a sense of awe — along with danger — as it currently applies to presidential hubris and supersized snacks. It’s no accident that the artists who work biggest are United States residents — not to mention men: Think of James Turrell, who transformed a crater in the Arizona desert into a massive temple to natural light; Richard Serra, whose hefty steel sculptures have blocked public plazas and famously crashed through a gallery floor; Christo, whose canvases are world landmarks and entire states; and even Jeff Koons, who effectively inflated a topiary puppy to the size of a mountain. They may have international reputations (and a few peers in other countries), but there is something undeniably American in the desire to realize dreams that large. The trick is to translate that sense of awe into something more than size envy.
Matthew Barney is perhaps the first contemporary artist to translate the idea of that monumental impulse to the media age. His latest venture, “Matthew Barney: Drawing Restraint,” which opens at the San Francisco Museum of Modern Art this week (look for a review in these pages soon), is a sizable, career-spanning project. Like most of his work, it involves a feature-length film, and objects and images that relate to a self-invented universe, one filled with references to the human body, landscapes, and landmarks. Perhaps, as some critics have suggested, Barney’s work extends the enveloping nature of film into three-dimensional space, or synthesizes various art forms into a Wagnerian gesamtkunstwerk — that total, epic extravaganza of a term that’s frequently attached to Barney. Whatever it’s called, it feels like something major.
A HIGH PRICE TO PAY?
Barney’s Drawing Restraint series — which comprises performances, videos, a feature film, and drawings — is rooted in the idea of struggle, transformation, and creation. The pieces in the ongoing series reflect the artist’s changing means — the earliest of them were done with Barney attempting to make drawings on the wall while shackled with rubber tethers or jumping on a trampoline and inscribing a self-portrait on the ceiling. Drawing Restraint 14, which was recently executed at SFMOMA, involved the artist scaling the building’s tubular skylight and drawing on the curved wall. Drawing Restraint 9, as has been widely reported, costars Barney’s real-life partner Björk, was filmed on a large Japanese whaling ship and employed the full crew as extras (a primary theme of the film is Barney’s identity as an occidental — read: American — in an inscrutable Japanese culture), and was realized on a budget of nearly $5 million.
That seems an attractive sum for an artist to be working with, but not when you compare it to the costs of this country’s greatest cultural exports — Hollywood movies — or even the price of an impressionist painting at auction. It definitely pales before Damien Hirst’s recently publicized bid to make the priciest work of art ever: a diamond-encrusted skull costing some $18.8 million. If Barney could raise those kinds of funds, most likely he’d have little trouble taking his vision to a next level, be it with CGI effects or with greater amounts of his signature material, petroleum jelly.
EXCESS AND RESTRAINT
The SFMOMA exhibition involved casting 1,600 gallons of the stuff, a relatively small amount in Barney terms, in a rectangular mold — a process that was slowed by clogged hoses and a minor rupture on the museum steps. As he did at the Guggenheim with his 2003 Cremaster Cycle exhibition, Barney easily occupies a good chunk of the museum. The show covers the whole of the fourth floor, which has, for the first time, most of its walls removed. The now-vast galleries house a few whale-sized sculptures, all illuminated with hundreds of industrial-looking lightbulbs installed by Barney’s crew. Clusters of sleek flat-screen monitors hang from the ceiling throughout. While it’s not the most expensive show that SFMOMA has mounted — recent ones involving less exotic materials have had much bigger price tags — Drawing Restraint feels deluxe, even if its most used material is cool, white plastic instead of precious stones.
Is Barney’s work gracious or self-absorbed? Is his work fueled by ego, the art market, or artistic drive? These are difficult questions, and although the Cremaster exhibition was accompanied by a telephone book–sized catalog with reams of explanatory text, it’s still difficult to know. Critic Jerry Saltz, in a review of Drawing Restraint 9, described Barney as “a mystic exploring his own inner cathedral.” It seems apt, as that religious edifice is a cavernous container in which to contemplate mystical phenomena, not to mention a form to which museums are often compared. We’re meant to enter them and be quietly wowed, whether we believe the dogma or not.
Those who have tickets to the already sold-out Barney lecture on June 23 — an example of his rock star status — will most likely come away with a sense that the artist possesses a genuine humbleness and an unerring drive to realize his vision. He thinks big, and manages to live up to his ambitions with dignity. Whatever you think of his work, you gotta admire his supersized pluck. SFBG

The Road to Guantánamo is the true story of three British citizens who were held without charges for two years at the American detention camps in Guantánamo Bay. Director Michael Winterbottom’s film combines documentary with dramatization in a way that is slightly confusing in the beginning, as we quickly cut between the men who were actually detained (Shafiq Rasul, Asif Iqbal, and Rhuhel Ahmed) and the actors who play them (Rizwan Ahmed, Arfan Usman, and Farhud Harun). The performances are first-rate, however, and the illusion of reality is created with harrowing enough detail that the gap between reportage and acting, or between documentary footage and reenactment, quickly seems irrelevant.
The worst thing a film like this can do is leave its audience feeling manipulated into believing something it was inclined to believe anyway. But The Road to Guantánamo consistently lets the story do its own work, and dumps us into the basic situation without too much backstory; it doesn’t make its protagonists overly heroic, paste any love stories over the narrative, or overwhelm its audience with music that tells us what we should be feeling.
For a film loaded with war casualties and torture, it’s disarmingly entertaining. What begins as a buddy-flick road movie quickly becomes a journey into hell. Three friends leave Britain for Pakistan, where a bride is waiting for one of them. A naive side trip to Afghanistan, just as the US bombing is getting under way, quickly carries them beyond the typical budget travel annoyances of gastrointestinal illness and makeshift restrooms and into a war-torn landscape full of the mutilated citizens of a country being indiscriminately bombed. Their final circle, however, is that abyss located both at the center of the American psyche and in Cuba. Rounded up with a batch of suspected Taliban fighters, our heroes come face-to-face with the Bush administration’s love affair with torture, humiliation, and endless detention without charge.
“Where’s Osama bin Laden?” the American interrogators ask their clueless victims, a question so ridiculous it is comic. The Americans are so perfectly American and so perfectly piggy that it’s easy to forget these scenes are being acted. Even in other recent films that package their torture as political critique, like Syriana and V for Vendetta, the subjects and objects of the verb “to torture” have been muddled; we’ve watched only white Americans and Brits enduring the worst, at the hands of Muslims, cartoon characters, or — in movies like Hostel, in which the torture is pure entertainment — East European whores and Germanic S-M fags. As in dreams, audiences probably understand that the roles are confused, and that Americans should actually be the ones wielding the clubs and attack dogs. Finally, however, we’ve been presented with a more accurate grammar: The Americans and British are torturing and the Muslims are tortured. For that reason alone, The Road to Guantánamo is an important and necessary film. SFBG

Put away the cameras

EDITORIAL The rate of violent crime in San Francisco, including murder, is climbing, and it’s way past unacceptable. Progressives aren’t generally known for their crime-fighting plans, but in this case the left flank of the Board of Supervisors, led by Ross Mirkarimi and Chris Daly, has offered a real, functional plan: an increase in community policing and additional funding for violence-prevention programs. However, Mayor Gavin Newsom and the cops are against that, and they helped knock it down on the June 6 ballot.
So what does the mayor want to do? He wants to put surveillance cameras — perhaps as many as 100 new surveillance cameras — all over the city, recording everything that happens in big swaths of public space, 24 hours a day.
The American Civil Liberties Union is urging the mayor to drop the plan. We agree.
For starters, there’s no evidence that cameras deter crime. Studies in England, where crime cameras are ubiquitous, show no decrease in criminal activity that can be linked to the cameras, and even studies in the United States suggest that criminals aren’t deterred by them. It’s possible cameras will help identify killers, particularly in neighborhoods where it’s almost impossible to find witnesses willing to talk — but it’s also possible (even likely) the bad guys will know exactly where the cameras are and either move somewhere else or wear masks.
And in exchange for this dubious benefit, San Franciscans will give up an immense amount of privacy.
We already live in a society where surveillance is an ugly fact of life. Credit card customers, grocery shoppers, cell phone and FasTrak users — almost all of us have our names and other details of our lives in electronic files, controlled by private firms and (as we’ve seen in the post–Sept. 11 era) easily accessible by government agencies.
The cameras offer such a huge potential for abuse. Will local or federal authorities use them to monitor political protests? Will they become a tracking device for people the feds consider a “threat”? Will they be used to monitor and suppress perfectly legal political activities and private associations?
No matter what the mayor and the San Francisco Police Department say, those cameras will be recording in public spaces, and those video files will exist somewhere, and even if they’re regularly erased (and given the SFPD’s record on following its own rules in other areas, we don’t trust that for a second), all it takes is a visit from the Department of Homeland Security to overrule all the safeguards. And anybody who thinks that won’t happen has been utterly out of touch with the state of the body politic in the past six years.
Another possibility the ACLU raises: Those videos could be considered public record in California — meaning stalkers, angry ex-spouses, and people planning violent crimes will have access to the daily movements of their potential victims.
The supervisors have, to their credit, tried to come up with rules to limit the potential abuses. But these sorts of technologies have a way of expanding, and law enforcement agencies have a way of avoiding oversight and scrutiny. There are much, much better ways to deter and fight violent crime. The best solution here is to simply cut the funding for the mayor’s cameras from next year’s budget. SFBG

A full-time school board

EDITORIAL The San Francisco Board of Education oversees a budget of more than $400 million. Its seven members attend regular board and committee meetings, analyze complex financial documents, visit school sites, meet with parents and administrators, attend conferences and trainings … and try to find a little bit of time to think about the future of public education in a very difficult urban situation. It’s one of the most important jobs in the city. And the board members get paid about $500 a month.

The members have no staff, just a secretary who handles messages and administrative duties for the entire board.

And you wonder why superintendents can run amok without proper oversight, why the budgets get passed with very little scrutiny, why the board members aren’t more actively involved in dealing with complex community issues like school closures. They just don’t have the time. Most of the board members have actual jobs; some, like Mark Sanchez (who teaches at a public school on the peninsula), have to use their vacation time to visit San Francisco schools.

It’s time to recognize what almost everyone in town concluded about the Board of Supervisors several years ago: This is a full-time job and ought to be treated as one.

Sure, paying the seven board members full-time salaries would cost some money, and the district is pinching every penny it has these days. But when you consider the benefits, the price tag is insignificant:

Full-time board members would be able to carefully manage district finances. Right now, the members get a budget document of more than 1,000 pages just days before they have to vote on it. There are almost certainly millions of dollars in that document that could be better spent, but only the administration the superintendent and his or her staff has the time to figure out what’s really going on.

The opportunity for public input would increase dramatically. School board meetings are once every two weeks, which is about all a part-time board can handle. Committee meetings are less frequent, and even when there are huge issues (like school closures) on the agenda, not all the members manage to show up. A full-time board could meet every week, hold regular committee meetings, and hold plenty of public hearings to get input on decisions.

Oversight would be transformed. When there are issues or problems involving San Francisco city departments, the supervisors can hold hearings, bring in the relevant parties, and get to the bottom of what’s going on. That never happens with the school board but it could, and with full-time board members, it would.

The city would get better candidates for the job. Right now it’s really hard for anyone who has a full-time job and kids in the public schools to sit on the school board. There are hundreds of people who would make excellent school board members who won’t even consider running because they just can’t afford to serve.

Full-time board members could actually market the schools. The SF schools badly need some goodwill ambassadors to show more parents the value of public education (and thus increase enrollment). That’s a perfect job for board members and a more functional board would present a much better image for the schools.

If the school board members were paid as much as San Francisco supervisors (roughly $80,000 a year), and if they each had one full-time staff aide, the total tab would run to around $1 million a year. We’re convinced that the resulting improved oversight and public input would allow the board to find far more than $1 million a year in savings elsewhere in the budget.

Giving the board members a huge raise is a tough sell when schools are closing and teachers are getting laid off. But it would transform the public schools and parents, teachers, and students would all be much better off. SFBG

Newsom loses control

In the early days, the mayor tried to sound like a practical, hands-on executive who was ready to run San Francisco.

Mayor Gavin Newsom used his inaugural address on Jan. 8, 2004, to emphasize that he was a uniter, not a divider and that he wanted to get things done.

"I say it’s time to start working together to find common purpose and common ground," he proclaimed. "Because I want to make this administration about solutions."

It’s a mantra he’s returned to again and again in his rhetoric on a wide range of issues, claiming a "commonsense" approach while casting "ideology" as an evil to be overcome and as the main motive driving the left-leaning majority of the San Francisco Board of Supervisors.

"Because it’s easy to be against something," Newsom said on that sunny winter day. "It’s easy to blame. It’s easy to stop…. What’s hard is to hear that maybe to come together, we need to leave behind old ideas and long-held grudges. But that’s exactly what we need to do."

But if that’s the standard, Newsom has spent the past 17 months taking the easy way.

It’s been a marked change from his first-year lovefest, when he tried to legalize same-sex marriage, reach out to BayviewHunters Point residents, and force big hotels to end their lockout of workers.

A Guardian review of the most significant City Hall initiatives during 2005 and 2006 as well as interviews with more than a dozen policy experts and public interest advocates shows that Newsom has been an obstructionist who has proposed few "solutions" to the city’s problems, and followed through on even fewer.

The Board of Supervisors, in sharp contrast, has been taking the policy lead. The majority on the district-elected board in the past year has moved a generally progressive agenda designed to preserve rental units, prevent evictions, strengthen development standards, promote car-free spaces, increase affordable housing, maintain social services, and protect city workers.

Yet many of those efforts have been blocked or significantly weakened by Newsom and his closest allies on the board: Fiona Ma, Sean Elsbernd, Michela Alioto-Pier, and Bevan Dufty. And on efforts to get tough with big business or prevent Muni service cuts and fare hikes, Newsom was able to peel off enough moderate supervisors to stop the progressives led by Chris Daly, Tom Ammiano, and Ross Mirkarimi at the board level.

But one thing that Newsom has proved himself unable to do in the past year is prevent progressive leaders particularly Daly, against whom Newsom has a "long-held grudge" that has on a few recent occasions led to unsavory political tactics and alliances from setting the public agenda for the city.

Balance of power

The Mayor’s Office and the Board of Supervisors are the two poles of power at City Hall and generally the system gives a strong advantage to the mayor, who has far more resources at his disposal, a higher media profile, and the ability to act swiftly and decisively.

Yet over the past year, the three most progressive supervisors along with their liberal-to-moderate colleagues Gerardo Sandoval, Jake McGoldrick, Aaron Peskin, and Sophie Maxwell have initiated the most significant new city policies, dealing with housing, poverty, health care, alternative transportation, violence prevention, and campaign finance reform.

Most political observers and City Hall insiders mark the moment when the board majority took control of the city agenda as last summer, a point when Newsom’s honeymoon ended, progressives filled the leadership void on growth issues, problems like tenants evictions and the murder rate peaked, and Newsom was increasingly giving signs that he wasn’t focused on running the city.

"Gay marriage gave the mayor his edge and gave him cover for a long time," said Tommi Avicolli Mecca, a queer and tenants rights activist. "About a year ago that started to wear off, and his armor started to be shed."

Daly was the one supervisor who had been aggressively criticizing Newsom during that honeymoon period. To some, Daly seemed isolated and easy to dismiss at least until August 2005, when Daly negotiated a high-profile deal with the developers of the Rincon Hill towers that extracted more low-income housing and community-benefits money than the city had ever seen from a commercial project.

The Newsom administration watched the negotiations from the sidelines. The mayor signed off on the deal, but within a couple months turned into a critic and said he regretted supporting it. Even downtown stalwarts like the public policy think tank San Francisco Planning and Urban Research Association noted the shift in power.

"I think we saw a different cut on the issue than we’ve seen before," SPUR executive director Gabriel Metcalf told us. "Chris Daly is not a NIMBY. I see Chris Daly as one of the supervisors most able to deal with physical change, and he’s not afraid of urbanism…. And he’s been granted by the rest of the board a lot of leadership in the area of land use."

SPUR and Metcalf were critical of aspects of the Daly deal, such as where the money would go. But after the deal, Newsom and his minions, like press secretary Peter Ragone, had a harder time demonizing Daly and the board (although they never stopped trying).

Around that same time, hundreds of evictions were galvanizing the community of renters which makes up around two-thirds of city residents. Newsom tried to find some compromise on the issue, joining Peskin to convene a task force composed of tenants activists, developers, and real estate professionals, hoping that the group could find a way to prevent evictions while expanding home ownership opportunities.

"The mayor views the striking of balance between competing interests as an important approach to governing," Ragone told the Guardian after we explained the array of policy disputes this story would cover.

The task force predictably fell apart after six meetings. "The mayor was trying to find a comfortable way to get out of the issue," said Mecca, a member of the task force. But with some issues, there simply is no comfortable solution; someone’s going to be unhappy with the outcome. "When that failed," Mecca said, "there was nowhere for him to go anymore."

The San Francisco Tenants Union and its allies decided it was time to push legislation that would protect tenants, organizing an effective campaign that finally forced Newsom into a reactionary mode. The mayor wound up siding overtly with downtown interests for the first time in his mayoral tenure and in the process, he solidified the progressive board majority.

Housing quickly became the issue that defines differences between Newsom and the board.

Free-market policy

"The Newsom agenda has been one of gentrification," said San Francisco Tenants Union director Ted Gullicksen. The mayor and his board allies have actively opposed placing limitations on the high number of evictions (at least until the most recent condo conversion measure, which Dufty and Newsom supported, a victory tenants activists attribute to their organizing efforts), while at the same time encouraging development patterns that "bring in more high-end condominiums and saturate the market with that," Gullicksen explained.

He pointed out that those two approaches coalesce into a doubly damaging policy on the issue of converting apartments into condominiums, which usually displace low-income San Franciscans, turn an affordable rental unit into an expensive condominium, and fill the spot with a higher-income owner.

"So you really get a two-on-one transformation of the city," Gullicksen said.

Newsom’s allies don’t agree, noting that in a city where renters outnumber homeowners two to one, some loss of rental housing is acceptable. "Rather than achieve their stated goals of protecting tenants, the real result is a barrier to home ownership," Elsbernd told us, explaining his vote against all four recent tenant-protection measures.

On the development front, Gullicksen said Newsom has actively pushed policies to develop housing that’s unaffordable to most San Franciscans as he did with his failed Workforce Housing Initiative and some of his area plans while maintaining an overabundance of faith in free-market forces.

"He’s very much let the market have what the market wants, which is high-end luxury housing," Gullicksen said.

As a result, Mecca said, "I think we in the tenant movement have been effective at making TICs a class issue."

Affordable housing activists say there is a marked difference between Newsom and the board majority on housing.

"The Board of Supervisors is engaged in an active pursuit of land-use policy that attempts to preserve as much affordable housing, as much rental housing, as much neighborhood-serving businesses as possible," longtime housing activist Calvin Welch told us. "And the mayor is totally and completely lining up with downtown business interests."

Welch said Newsom has shown where he stands in the appointments he makes such as that of Republican planning commissioner Michael Antonini, and his nomination of Ted Dienstfrey to run Treasure Island, which the Rules Committee recently rejected and by the policies he supports.

Welch called Daly’s Rincon deal "precedent setting and significant." It was so significant that downtown noticed and started pushing back.

Backlash

Board power really coalesced last fall. In addition to the housing and tenant issues, Ammiano brought forward a plan that would force businesses to pay for health insurance plans for their employees. That galvanized downtown and forced Newsom to finally make good on his promise to offer his own plan to deal with the uninsured but the mayor offered only broad policy goals, and the plan itself is still being developed.

It was in this climate that many of Newsom’s big-business supporters, including Don Fisher the Republican founder of the Gap who regularly bankrolls conservative political causes in San Francisco demanded and received a meeting with Newsom. The December sit-down was attended by a who’s who of downtown developers and power brokers.

"That was a result of them losing their ass on Rincon Hill," Welch said of the meeting.

The upshot according to public records and Guardian interviews with attendees was that Newsom agreed to oppose an ordinance designed to limit how much parking could be built along with the 10,000 housing units slated for downtown. The mayor instead would support a developer-written alternative carried by Alioto-Pier.

The measure downtown opposed was originally sponsored by Daly before being taken over by Peskin. It had the strong support of Newsom’s own planning director, Dean Macris, and was approved by the Planning Commission on a 61 vote (only Newsom’s Republican appointee, Antonini, was opposed).

The process that led to the board’s 74 approval of the measure was politically crass and embarrassing for the Mayor’s Office (see “Joining the Battle,” 2/8/06), but he kept his promise and vetoed the measure. The votes of his four allies were enough to sustain the veto.

Newsom tried to save face in the ugly saga by pledging to support a nearly identical version of the measure, but with just a couple more giveaways to developers: allowing them to build more parking garages and permitting more driveways with their projects.

Political observers say the incident weakened Newsom instead of strengthening him.

"They can’t orchestrate a move. They are only acting by vetoes, and you can’t run the city by vetoes," Welch said. "He never puts anything on the line, and that’s why the board has become so emboldened."

Rippling out

The Newsom administration doesn’t seem to grasp how housing issues or symbolic issues like creating car-free spaces or being wary of land schemes like the BayviewHunters Point redevelopment plan shape perceptions of other issues. As Welch said, "All politics in San Francisco center around land use."

N’Tanya Lee, executive director of Coleman Advocates for Children and Youth, said the Newsom administration has done a very good job of maintaining budgetary support for programs dealing with children, youth, and their families. But advocates have relied on the leadership of progressive supervisors like Daly to push affordable housing initiatives like the $20 million budget supplemental the board initiated and approved in April.

"Our primary concern is that low- and moderate-income families are being pushed out of San Francisco," Lee told us. "We’re redefining what it means to be pro-kid and pro-family in San Francisco."

Indeed, that’s a very different approach from the so-called pro-family agenda being pushed by SFSOS and some of Newsom’s other conservative allies, who argue that keeping taxes low while keeping the streets and parks safe and clean is what families really want. But Lee worries more about ensuring that families have reasonably priced shelter.

So she and other affordable housing advocates will be watching closely this summer as the board and Newsom deal with Daly’s proposal to substantially increase the percentage of affordable housing developers must build under the city’s inclusionary-housing policy. Newsom’s downtown allies are expected to strongly oppose the plan.

Even on Newsom’s signature issue, the board has made inroads.

"In general, on the homeless issue, the supervisor who has shown the most strong and consistent leadership has been Chris Daly," said Coalition on Homelessness director Juan Prada.

Prada credits the mayor with focusing attention on the homeless issue, although he is critical of the ongoing harassment of the homeless by the Police Department and the so-called Homeward Bound program that gives homeless people one-way bus tickets out of town.

"This administration has a genuine interest in homeless issues, which the previous one didn’t have, but they’re banking too much on the Care Not Cash approach," Prada said.

Other Newsom initiatives to satisfy his downtown base of support have also fallen flat.

Robert Haaland of the city employee labor union SEIU Local 790 said Newsom has tried to reform the civil service system and privatize some city services, but has been stopped by labor and the board.

"They were trying to push a privatization agenda, and we pushed back," Haaland said, noting that Supervisor Ma’s alliance with Newsom on that issue was the reason SEIU 790 endorsed Janet Reilly over Ma in the District 12 Assembly race.

The turning point on the issue came last year, when the Newsom administration sought to privatize the security guards at the Asian Art Museum as a cost-saving measure. The effort was soundly defeated in the board’s Budget Committee.

"That was a key vote, and they lost, so I don’t think they’ll be coming back with that again," Haaland said, noting that labor has managed to win over Dufty, giving the board a veto-proof majority on privatization issues.

Who’s in charge?

Even many Newsom allies will privately grumble that Newsom isn’t engaged enough with the day-to-day politics of the city. Again and again, Newsom has seemed content to watch from the sidelines, as he did with Supervisor Mirkarimi’s proposal to create a public financing program for mayoral candidates.

"The board was out front on that, while the mayor stayed out of it until the very end," said Steven Hill, of the Center for Voting and Democracy, who was involved with the measure. And when the administration finally did weigh in, after the board had approved the plan on a veto-proof 92 vote, Newsom said the measure didn’t go far enough. He called for public financing for all citywide offices but never followed up with an actual proposal.

The same has been true on police reform and violence prevention measures. Newsom promised to create a task force to look into police misconduct, to hold a blue-ribbon summit on violence prevention, and to implement a community policing system with grassroots input and none of that has come to pass.

Then, when Daly took the lead in creating a community-based task force to develop violence prevention programs with an allocation of $10 million a year for three years Measure A on the June ballot Newsom and his board allies opposed the effort, arguing the money would be better spent on more cops (see “Ballot-Box Alliance,” page 19).

"He’s had bad counsel on this issue of violence all the way through," said Sharen Hewitt, who runs the Community Leadership Academy Emergency Response project. "He has not done damn near enough from his position, and neither has the board."

Hewitt worries that current city policies, particularly on housing, are leading to class polarization that could make the problems of violence worse. And while Newsom’s political allies tend to widen the class divide, she can’t bring herself to condemn the mayor: "I think he’s a nice guy and a lot smarter than people have given him credit for."

Tom Radulovich, who sits on the BART board and serves as executive director of Transportation for a Livable City (which is in the process of changing its name to Livable City), said Newsom generally hasn’t put much action behind his rhetorical support for the environment and transit-first policies.

"Everyone says they’re pro-environment," he said.

In particular, Radulovich was frustrated by Newsom’s vetoes of the downtown parking and Healthy Saturdays measures and two renter-protection measures. The four measures indicated very different agendas pursued by Newsom and the board majority.

In general, Radulovich often finds his smart-growth priorities opposed by Newsom’s allies. "The moneyed interests usually line up against livable city, good planning policies," he said. On the board, Radulovich said it’s no surprise that the three supervisors from the wealthiest parts of town Ma, Elsbernd, and Alioto-Pier generally vote against initiatives he supports.

"Dufty is the oddity because he represents a pretty progressive, urbane district," Radulovich said, "but he tends to vote like he’s from a more conservative district."

What’s next?

The recent lawsuit by the San Francisco Chamber of Commerce and the Committee of Jobs urging more aggressive use of a voter-approved requirement that board legislation undergo a detailed economic analysis shows that downtown is spoiling for a fight (see “Downtown’s ‘Hail Mary’ Lawsuit,” page 9). So politics in City Hall is likely to heat up.

"There is a real absence of vision and leadership in the city right now, particularly on the question of who will be able to afford to live in San Francisco 20 years from now," Mirkarimi said. "There is a disparity between Newsom hitting the right notes in what the press and public want to hear and between the policy considerations that will put those positions into effect."

But Newsom’s allies say they plan to stand firm against the ongoing effort by progressives to set the agenda.

"I think I am voting my constituency," Elsbernd said. "I’m voting District Seven and voicing a perspective of a large part of the city that the progressive majority doesn’t represent."

Newsom flack Ragone doesn’t accept most of the narratives that are laid out by activists, from last year’s flip in the balance of power to the influence of downtown and Newsom’s wealthy benefactors on his decision to veto four measures this year.

"Governing a city like San Francisco is complex. There are many areas of nuance in governing this city," Ragone said. "Everyone knows Gavin Newsom defies traditional labels. That’s not part of a broad political strategy, but just how he governs."

Yet the majority of the board seems unafraid to declare where they stand on the most divisive issues facing the city.

"The board has really, since the 2000 election has been pushing a progressive set of policies as it related to housing, just-taxation policies, and an array of social service provisions," Peskin said. "All come with some level of controversy, because none are free." SFBG

It’s Easter weekend in the Mission District, and despite the rabbit snuffling around Rick Popko’s backyard, Cadbury eggs are the last thing on anyone’s mind. "I think we’ve killed everyone we know," Popko explains grimly, grabbing his cell phone to try and recruit one more zombie for the final day of filming on the horror comedy RetarDEAD. Moments later, Popko and RetarDEAD codirector Dan West survey the scene in Popko’s basement. To put it mildly, it’s a bloodbath: The ceiling, walls, and carpet are dripping with cherry red splatters. A smoke machine sits primed for action near a table loaded with gore-flecked prop firearms.

Waste not

Several weeks later (plus several coats of paint, though a faint pinkness lingers), what had been a gruesome morgue has now reverted to its natural domestic state, save an editing station assembled at one end. A framed poster commemorating Popko and West’s first feature, 2003’s Monsturd, hangs on a nearby wall.

Monsturd is a true B-movie. Thanks to some seriously weird science, a serial killer morphs into a giant hunk of raging poop. Drawn into this sordid small-town tale are an evil doctor, a down-and-out sheriff, and an intense FBI agent, plus Popko and West as a pair of screwball deputies. Toilet jokes abound. After a three-day premiere at San Francisco’s Victoria Theatre, Monsturd found some success on video, most triumphantly surfacing in Blockbuster after the chain purchased 4,000 DVD copies.

Popko and West hope Monsturd‘s cult notoriety will aid RetarDEAD, which happens to be its direct sequel. It starts exactly where Monsturd ended. "Dr. Stern [the mad scientist played by Popko-West pal Dan Burr] rises from the sewer," West explains. "He gets a job at an institute for special education and starts a test group on these special ed students. They become remarkably intelligent, and then the side effect is they become zombies."

"In a nutshell, we kind of liken it to Flowers for Algernon meets Night of the Living Dead," Popko interjects.

"It’s a background gag to get the whole premise of the joke title. People go, ‘Well, why is it RetarDEAD?’ It’s because we needed a gimmick," says West, adding that the title came before the film (and was settled upon after an early choice, Special Dead, was snatched up by another production).

Best friends since bonding over a shared love of Tom Savini, circa 1984, at Napa’s St. Helena High School, Popko and West are so well matched creatively that Burr describes them as "like the left hand and the right hand" on the same body. Both are keen on beguiling titles. Monsturd‘s original moniker (Number Two, Part One) was dropped after being deemed too esoteric; Monsturd, they figured, would solicit more interest in video stores.

"We knew it’s such a stupid title that you would have to rent it just to see if it was as dumb as you thought it was," West explains. And for self-financed filmmakers like West and Popko (who both have full-time jobs and estimate they spent $3,000 on Monsturd and $12,000 to $14,000 so far on RetarDEAD), clever marketing strategies are essential.

"We have to think, when we’re making these movies, what can we sell, what can we get out there, what can we make a name for ourselves with?" Popko says.

"On this level, you go to the exploitation rule, which is give ’em what Hollywood cannot or will not make," West adds. "And they’re not gonna make Monsturd."

Dirty deeds . . .

Monsturd took years to complete and taught the duo scores about the capriciousness of the DVD distribution biz. Though one review dubbed it "the greatest movie that Troma never made," Popko and West actually turned down a deal with the famed schlock house, unwilling to sign over the rights to their film for 25 years. After hooking up with another distributor, they didn’t see any money from their Blockbuster coup. Still, they remain proud of Monsturd and its success.

"We tried to make it the best movie we possibly could, but we had nothing," West explains. "We didn’t piss it out in a weekend. It took a year to shoot it, then it took a year to put the thing together."

"We didn’t just shit out a crappy movie, pardon the pun," Popko says.

Neither filmmaker seems concerned that their trash-tastic subject matter might prevent them from being taken seriously as artists. And it doesn’t bother them that Monsturd‘s joke tends to overshadow the film itself not just for viewers, but for critics, who were by and large polarized by the killer shit-man tale.

Popko also recalls unsuccessfully submitting Monsturd to a half dozen film festivals intended to showcase DV and underground flicks. Quickly pointing out that the film got picked up anyway, he blames image-conscious programmers: "It’s like, how can you have a respectable film festival when you’ve got a shit monster movie playing in it?"

Though Popko and West live in San Francisco and filmed both Monsturd and RetarDEAD in Northern California, they say they don’t feel like part of the San Francisco filmmaking scene. Again, they suspect the whiff of poo might have something to do with it.

"We’ve kind of been ignored," West says. "We’re not bitter about it, but it would be nice to be acknowledged for what we’re doing we’re making exploitation films, and we don’t really have any guilt about what we’re doing. It’d be nice for somebody to develop a sense of humor and acknowledge it once in a while."

. . . done dirt cheap

As with Monsturd, RetarDEAD is a nearly all-volunteer effort, pieced together when the responsibilities of real life permit. Despite the obstacles say, a sudden insurance crisis involving a rented cop car unpredictability is clearly part of the thrill.

"When you undertake this shit, it’s an adventure: ‘What did you do this weekend?’ ‘Well, I was chased by 42 zombies, and the weekend before that, a bunch of burlesque dancers ripped our villain apart and ripped his face off,’” West explains. "It’s like, how else would you spend your free time?"

This sentiment extends to the film’s cast, several of whom have known Popko and West for years and reprise their Monsturd roles in its sequel. Coming aboard for RetarDEAD were members of San Francisco’s Blue Blanket Improv group, as well as the Living Dead Girlz, a zombie-flavored local dance troupe.

Beth West, who jokingly calls herself a "fake actor," stars in both films as the X-Files-ish FBI agent (Dan West’s former wife, she was roped into the first production after the original lead dropped out). Despite both films’ bare-bones shoots and other concerns, like trying (and failing) to keep continuity with her hairstyle over multiple years of filming she remains upbeat about the experience: "I loved being part of such a big creative effort."

Though his character is torn to shreds in RetarDEAD, Burr agrees. "This film is going to be 100 times better than the last one, as far as direction, camera shots everyone was more serious this time," he says. He hopes that RetarDEAD will help Popko and West expand their audience. "Someone’s gonna notice the talent there. Maybe not in the acting, but this is these guys’ lives. It’s never been my whole dream, but it’s always been their whole dream."

Splatter-day saints

For RetarDEAD, technical improvements over Monsturd, including the introduction of tracking shots, were important considerations. However, first things first: "We knew we wanted this to be gory as fuck," West says. An ardent fan of Herschell Gordon Lewis notorious for stomach turners like 1963’s Blood Feast West once hoped to lens a biopic of Lewis and his producing partner, David Friedman. Though it was never completed, he did get the Godfather of Gore’s permission to use a snippet of dialogue from the project in RetarDEAD.

"This whole thing begins with his intro it’s like that Charlton Heston thing for Armageddon, where it’s like the voice of God but it’s Herschell Gordon Lewis talking about gore," West says. "It was the one way I could go to my grave saying I finally figured out a way to work with Herschell Gordon Lewis."

Appropriately enough, RetarDEAD pays homage to Lewis’s signature style. "Monsturd had a couple of bloody scenes in it, but it was pretty tame," Popko says. "This here, we’re planning on passing out barf bags at the premiere because, I mean, it’s gross. We’ve got intestines and chain saws and blood all over the place."

Overseeing the splatter was director of special effects Ed Martinez, one of the few additional crew members (and one of few who were paid). A late addition to the production, he "made the movie what it is," according to West.

"A zombie film in this day and age, you can’t do amateur-quality makeup and get away with it it’ll be a flop," says Martinez, who teaches special effects makeup at San Francisco’s Academy of Art University and is a veteran of films like The Dead Pit. "And [Popko and West] know that."

Though Martinez is used to working on bigger projects, he stuck with RetarDEAD dreaming up such elaborate moments as a Day of the Deadinspired man-ripped-in-half sequence because, as he says, "In a way, I’m a coconspirator now." He also appreciates the directors’ sheer enthusiasm and appreciation. After a killer take, they were "literally high-fiving me. Most low-budget filmmakers are so egocentric they would rarely do anything like that. Good effects are important, but they’re not the only things that are important."

Dawn of RetarDEAD

Though a third movie in the Popko-West canon is already in the planning stages (Satanists!), it’s looking like several months before RetarDEAD still being edited from 30-plus hours of raw footage has its world premiere.

"We only get one to two nights a week to do this," Popko explains. Making movies for a living is the ultimate dream, but for now, both men view their films as being in the tradition of early John Waters: made outside the system and laden with as much bad taste as they please. Potential distributors have already advised the pair to adjust RetarDEAD‘s divisive title, a notion they considered "for about five minutes," according to West.

Popko and West’s films may be throwbacks to the drive-in era, but their outlook on the movie biz is actually quite forward-looking. Popko "the carnival barker" to West’s "guy behind the curtain pulling levers and switching things," according to Burr anticipates a day when tangling with queasy distributors won’t even be necessary, because many films will simply be released directly over the Internet. Both directors are also very interested in high-definition technology; they plan to upgrade from their old DV camera to a new HD model for their next effort, for reasons beyond a desire for better visual quality.

"What HD has done is bring grind house back," West says. "Now you can make stuff on a level that can compete, aesthetically, with what Hollywood’s doing almost. As far as your talent, you’ll be able to compete realistically with other movies. Now people can make good horror movies on their own terms."

"If you really want to make a movie, you can," Popko notes, stressing the importance of production values. Though the cutthroat nature of the indie film world is always on their minds, they welcome the new wave of B-movies that HD may herald.

"Now, there aren’t movies like Shriek of the Mutilated that were done in the 1970s, which could compete [with Hollywood]. These movies can now come back into the fold as long as they’re shot on HD and there will be a shit fest like none other," West predicts, adding that he’s looking forward to the deluge. "The world’s a better place with shitty movies in it." SFBG

Maggie Agnew knows more about gun violence than anyone should ever have to know. Three of her children have been murdered since 1986, all of them during altercations that involved guns.

The church she attends has done all it can to help her and other parents of homicide victims. But not everyone attends church, she says. More needs to be done.

That’s why she along with three other women affected by the city’s epidemic of violence has signed her name to Proposition A, a June ballot measure authored by Sup. Chris Daly.

Prop. A would allocate $10 million a year for homicide-prevention services from the city’s General Fund for each of the next three years.

It would also create a survivors’ fund in the District Attorney’s Office to assist with burial expenses and counseling.

Agnew says that it’s a good start.

"There are so many parents who are like me; they can barely have a funeral and bury their children," Agnew told the Guardian recently. "You’re left with big bills, heartache, and pain. If you don’t have support, you’re out in the cold."

The Prop. A campaign is about more than just the relatively modest $10 million. Progressives and communities of color have begun to build an alliance around the measure that hasn’t always existed in the past which is a polite way of referring to the left’s sometime failure to address problems afflicting minority communities.

The San Francisco Peoples’ Organization, PowerPAC, and two past presidents of the Harvey Milk Democratic Club have appeared as supporters in election literature, along with Agnew, Betty Cooper, Kechette Walls Powell, and Mattie Scott, four women who have lost relatives to homicide. The effort began earlier this year as the board debated making supplemental appropriations from surplus budget money for similar support services after the city’s homicide rate approached the triple digits.

Sharen Hewitt, director of the Community Leadership Academy Emergency Response project, said the alliance is a small step in the right direction.

"It ain’t been no lovefest," she said frankly. "I am a progressive, as you know. But my community has been dropping dead in the street, and we’ve been focused on bike lanes…. We came together with a struggle."

Hewitt said the proposition allows for a considerable amount of flexibility: Money will go to the neighborhoods most affected by homicide, not simply those presumed to be in the most need. Overall, she said, the city has relied too much on the police, and the symptoms of violence, such as poverty, still need to be addressed.

"We have to be candid with each other, so we can form a real progressive agenda and not leave anyone behind," Hewitt said.

Prop. A is not without its critics. Sups. Sean Elsbernd, Michela Alioto-Pier, and Jake McGoldrick and Mayor Gavin Newsom all oppose it.

San Francisco is already struggling to abide by a charter mandate that requires the city to maintain a force of at least 1,971 police officers at all times, critics complain. Newsom and his allies on the board believe hiring new cops is more important than what the ballot measure proposes.

Elsbernd told us he’s also opposed to Prop. A because it locks in yet more budget requirements, when supplemental appropriations could be used to keep control in the hands of board members.

"My concern is it’s a set-aside," he said. "It binds the hands of the executive and legislative branches…. This is ballot-box budgeting."

Money from Prop. A would target areas with high rates of violence by focusing services on job creation and workforce training, conflict resolution, substance abuse and mental health treatment, and probation and witness relocation services. The measure would also form an 11-member community planning council charged with drafting and revising an annual homicide-prevention plan.

PowerPAC president Steve Phillips agrees with the other Prop. A proponents that the police approach hasn’t been sufficient, and says progressives and minorities need to show more allied leadership to promote better answers.

"There’s been an epidemic of violence that the city’s been unable to address," he said. "We wanted to give money to those communities most impacted by violence." SFBG

Downtown’s “Hail Mary” lawsuit

EDITORIAL This one is way over the top: The San Francisco Chamber of Commerce and the Committee on Jobs filed suit last week against the San Francisco Board of Supervisors, alleging that the supes won’t implement Proposition I, the 2004 ballot measure that was aimed at derailing progressive legislation. The suit makes little legal sense: The downtown crew is demanding that the city do something that it’s already doing, for the most part. But it shows an aggressive new strategy on the part of Mayor Gavin Newsom’s allies, who are out to scuttle three important bills that will probably win board approval.

Prop. I was designed to do two things: Delay anything that downtown might consider "antibusiness" and promote the political fortunes of Michela Alioto-Pier, who authored the ballot measure. The idea: Create an Office of Economic Analysis, under the city controller, with the responsibility to do an "economic impact analysis" of any legislation that comes before the board. Of course, that economic impact analysis will by definition be fairly narrowly focused; it won’t consider the social impacts or consequences of decisions.

That was always the flaw in Prop. I, and that was the reason we opposed the measure. Economic impact studies that show only how much a proposal would cost or how it might harm the "business climate" ignore the fact that a lot of government regulation improves things that aren’t quantifiable. And even when they can be measured, certain effects are ignored: Clean air has a tremendous value but typical studies of antipollution measures focus only on the costs of compliance. Safe streets, nice parks, and good schools are worth a fortune but a study that examines the tax burden required to pay for them won’t account for that.

Downtown spent a fortune promoting the measure (and sending out colorful flyers with Alioto-Pier’s face on them, which didn’t hurt her reelection efforts). It narrowly passed but since Alioto-Pier never put in a request for the additional money the plan would cost, it took an entire city budget cycle to fund and hire the two staff economists who will do the work.

Now, for better or for worse, they’re on board, and the analyses are beginning but downtown isn’t satisfied. Chamber spokesperson Carol Piasente told us the group wants to eliminate any board discretion in deciding what needs analysis and what doesn’t; right now, the board president can waive the analysis on relatively trivial things like resolutions and appointments.

But what’s really going on, according to Sup. Chris Daly, is that downtown is gearing up for a full-scale attack on three bills: Sup. Tom Ammiano’s proposal to require employers to pay for health care; Sup. Sophie Maxwell’s plan to better enforce the minimum wage laws; and Daly’s proposal to require additional affordable housing in all market-rate developments. "Downtown’s hail mary pass involves using the economic analysis to kill these socially critical proposals," Daly wrote in his blog.

Oh, and while the chamber is always worried about city spending, the group’s lawyer, Jim Sutton, is asking for attorney’s fees (likely to be a big, fat chunk of taxpayer change) if the suit prevails.

This is ridiculous. City Attorney Dennis Herrera needs to defend this aggressively, but that’s only the legal side. The mayor, who has become ever more closely allied with these downtown forces (see page 11), ought to join the supervisors in publicly denouncing the suit. SFBG

Why Conroy should go

EDITORIAL Mayor Gavin Newsom made a weak attempt to deal with the political fallout from the Office of Emergency Services audit last week, appointing Laura Phillips, who appears to have some qualifications for the job, as the head of emergency communications.

But Newsom refuses to follow the most important recommendation from the scathing audit. OES director Annemarie Conroy still has her job.

It’s more than a little bit unsettling: Newsom, who claims to be a competent manager, is sticking with Conroy, the Donald Rumsfeld of San Francisco, an incompetent political crony who won the job only as part of a stupid and transparently political deal.

The audit, by Board of Supervisors budget analyst Harvey Rose, shows why this sort of political chess game is such a bad idea. Conroy, who had no credentials whatsoever for the top disaster planning job, has, not surprisingly, fared poorly. Her office, the audit says, is larded with top management a full 40 percent of her staff are at the highly paid management level, which Rose called "unacceptable" while little of the $82 million it’s received in federal and state grants has gone to emergency training. Conroy has bungled efforts at coordinating disaster planning with other departments and hasn’t even applied for federal reimbursement for some $7.6 million that the city is owed.

Conroy, a lawyer and former supervisor, got the $170,000-a-year job largely because Newsom wanted to get Tony Hall off the Board of Supervisors. So he offered Hall a plum job running the Treasure Island Development Authority but since Conroy was already in that job, Newsom had to move her someplace else, and he chose emergency services. The problem is, this is no sleepy bureaucratic backwater where a hack can rest on a nice salary for a few years without doing any real damage. The OES handles a huge amount of money and is responsible for getting the city ready for things like a major earthquake, which every scientist agrees is overdue, or a terrorist attack, which is certainly not outside the realm of possibility.

This was the sort of game former mayor Willie Brown played all the time, shuffling political allies around to agencies and commissions without much regard for the public policy impact. Newsom promised to do better, but the fact that he’s still standing behind Conroy is evidence that he’s letting old-fashioned politics get in the way of running the city.

Let’s face it: Annemarie Conroy should never have been appointed to the OES and clearly isn’t up to the job. Rose recommends abolishing her position and letting the new head of emergency communications run the whole show. That seems like an excellent idea. SFBG

The gluttonous Willie Brown era lead to a city workforce of mangers who earned princely salaries in exchange for their political loyalty, but appeared to have little in the way of clear job responsibilities.

The cries for reform from auditors and other watchdogs eventually fueled the creation of a Management Classification and Compensation Plan designed to both streamline the city’s hiring process and trim a top-heavy class of department managers.
 
The process has been slow and complex, to put it lightly. But one way to measure its effectiveness so far may be to consider the complaints coming from political hacks bitter about losing status on the city’s totem pole.
 
In April, the Guardian reported that former board supervisor Bill Maher, now a “regulatory affairs manager” at the San Francisco International Airport, seemed to have difficulty showing up for work even half the time, according to documents we’d obtained that tracked his usage of a complimentary airport parking card included in his compensation package.

Maher was a Willie Brown political ally who earned his $95,000-a-year post at the airport in 1998 under the former mayor. Since then, he’s managed to hang on to the job and sail through more $30,000 in raises, to $128,000, despite a dubious job description.

But when the human resources department set its sights on Maher’s job through an MCCP review, he was knocked back from a Manager V position to Manager III in early 2004.
 
Maher shouldn’t have had much to complain about; the change did not affect his current salary. But the change did affect his eligibility for certain types of pay raises in the future, so Maher lashed out, warning MCCP Team Coordinator Robert Pritchard in an April 2004 letter that he planned to appeal the decision to the Civil Service Commission. In the letter, Maher valiantly made a renewed attempt to describe exactly what it is that he does for the airport:
 
“Reporting directly to the airport director, this position serves as a political consultant/advisor to the Airport Director regarding the political climate and assists the Director in the overall management, planning and coordination of highly political, sensitive and politically visible projects as assigned.”
 
Huh? Wha?
 
Apparently, the position wasn’t “political” enough, because after further review, Pritchard recommended to the commission earlier this month that Maher’s appeal be denied. According to Pritchard’s findings, “ …the position has no supervisory or budgetary responsibilities typical of the higher level classes.”
 
As it happens, the city’s budget analyst, Harvey Rose, agreed Maher’s duties seemed vague at best, because he recently made the preliminary recommendation that Maher’s job be eliminated entirely. According to a May 22 report from Rose’s office, the decision was based on “the lack of workload and deliverables information, the duplicative nature of the position’s functions, and the position’s high cost …” (Rose’s final budget recommendations won’t be finished until June 5.)
 
The Guardian also reported in April that management excess appeared to exist elsewhere at the airport. We noted that sources of ours had complained about the airport’s International Economic and Tourism Development Director, a post created for the politically well-connected Bill Lee under Gavin Newsom after the mayor removed Lee from his job as city manager. (The San Francisco Chronicle’s Matier & Ross have published versions of this story as well.)
 
Lee’s salary and mandatory fringe benefits, including a city car, cost taxpayers nearly $186,000 a year. His job, according to Rose’s report, is to “support international business growth.” But the airport never provided to Rose data that proved Lee had inspired any growth in international cargo or passengers. Rose, subsequently, made the preliminary recommendation that Lee’s position also be eliminated by late September “based on the lack of quantifiable economic benefits and cost savings associated with this position …”
 
No one at the airport’s Bureau of Community Affairs was available to comment on either Lee or Maher’s positions. But in April, Lee disputed any suggestion that his job was merely a “soft landing,” and insisted that he’s continuing to establish new business relationships between the city and key Asian countries.
 
Airport Spokesman Michael McCarron also told us in April that Maher spends much of his time off site “reviewing and attending appropriate board, commission and regulatory meetings.”
 

As part of his explanation, McCarron added at the time, “It is important for the airport to be aware of community sentiment that may impact the airport and the regulatory climate within in [sic] which it must exist.”
