Yesterday’s, er, news that men (sex, sex, sex, money, money, sports) take greater risks after viewing porn, got me wondering what will happen to the stock market when the feds start spraying female moth pheromones.

Seriously folks, to reassure us all, the California Department of Food and Agriculture sent this transcript of the Governor speaking from Salinas.

“Hello-Today, Governor Schwarzenegger was in Salinas to continue statewide discussions on budget reform.
After his event, the local ABC station asked him about LBAM spraying. The transcript is below. Thought you may find it interesting.

ABC: Will you comment on LBAM spraying?

Governor: It’s important we do everything we can because it can destroy our agriculture products and harm our environment. Other countries can cut off our agriculture trade. Public safety is my number one priority and there is nothing that shows this program is unsafe.

ABC: Senator Migden is proposing legislation to prevent spraying before an EIR is done. Do u have a position?

Governor: We have done all the studies in the world and nothing says it is unsafe. We wouldn’t spray if it were unsafe.

ABC: You would look these people in the eye and tell them it is safe?

Governor: This is safe. The spraying is safe and there is nothing that says otherwise.

Meanwhile, folks who remain unconvinced that the spraying is safe are being urged…to catch a bus to Sacramento tomorrow, April 16.

Okay, so maybe that’s actually the phrase Rush Limbaugh uses to describe LGBT rights. But when the folks in law enforcement, mostly a conservative bunch, start demanding special treatment, shouldn’t conservative pundits hit the ceiling then, too? Of course not. That would alienate a significant portion of their listening audience.

We’ve already written in the past about police in the state of California winning special protections against publicly disclosing their personnel records. But why should their salaries be kept secret also? And their badge numbers? And, the Contra Costa Times explains in that last link, their identities?

Being a cop is tough, yeah. Just read the thousands of pages of evidence filed in Superior Court for Dennis Herrera’s gang injunctions. They read like an episode of The Wire. (Seriously, we’re surprised more reporters aren’t pouring over those records. There’s a whole lot in there about local criminal activity you haven’t seen in the news, and this is the only time you’ll have public access to so many details of what the SFPD’s Gang Task Force is up to.)

But why should salaries be kept secret, particularly when the police union’s new contract has played such a significant role in this year’s local budget deficit? All those stories from Matier & Ross about how much it costs to provide a police presence at political demonstrations would just be ruined if the police had their way. The CoCo Times and the LA Times have already been through this battle with the state Supreme Court.

The new zoo blues

Ten years ago, the San Francisco Zoo asked voters for $48 million in bonds to overhaul its decaying animal enclosures, rebuild its entrance, expand educational facilities for children, and make a host of other improvements.

Every major figure in San Francisco with even an ounce of political ambition made sure his or her name was attached to the voter information pamphlet that went out to residents in 1997 urging passage of the bonds.

The list included Willie Brown, Dianne Feinstein, and Nancy Pelosi; members of the community college and school boards; the district attorney and city attorney then in office; Republican judges and local chambers of commerce; and countless grade school teachers.

The entire board of supervisors signed on, declaring that the improvements would "include new habitats where many of the animals will experience grass under their feet for the first time."

Prop. C passed, and the private San Francisco Zoological Society, which had taken control of the zoo from the city five years before, was on its way to introducing real live sod to exotic animal species. Just like a sanctuary, or even the wild itself.

But it hasn’t quite turned out like the pretty pictures suggested.

On March 18, the San Francisco Animal Control and Welfare Commission quietly released a report that made it clear many of the promises of that bond campaign were never kept. The private zoo didn’t spend the money the way all of those giddy city officials had told the voters it would.

The report was largely overlooked because on the same day the Association of Zoos and Aquariums, which inspects San Francisco’s zoo for accreditation, released its own long-anticipated investigation of what happened at Christmastime when a hulking Siberian tiger named Tatiana mauled three people, killing one.

That attack, as we all know now from the relentless headlines, is the sexier story. But the commission, in a document with much greater long-term implications, said that only two significant new exhibits were built using the bond money — the African Savannah and the Lemur Forest, completed in 2004 and 2002 respectively.

A scheduled $13.4 million Great Ape Forest was deferred from the list of projects. The zoo promised that project would "remain a fundraising goal for the SF Zoological Society," according to an update on the bond expenditures presented to the public in 2005. Orangutan and chimpanzee exhibits scheduled for improvement with the bond money were cancelled, the commission said, and the lone hippo was moved to an "arguably worse exhibit."

Besides a new exhibit for grizzlies, habitations for the other bears "have not undergone any meaningful renovation," according to the commission.

And while the zoo spent the last decade downgrading projects promised to voters from the construction of new exhibits to the mere renovation of existing ones, others targeting the feel-good sensibilities of patrons that had little to do with actually caring for animals were completed as swiftly as possible.

The zoo’s miniature train system, "Little Puffer," was fully restored with $700,000 worth of private funds in 1998. A $4 million education center, which doesn’t actively house animals, was completed in 2001 using the bond money. A new entryway, improved streetscapes, parking, and a restaurant costing $20 million, which came largely from the zoo bonds, were completed two years late and $10 million over budget in 2002.

The renovation of an amusement ride for kids — the historic Dentzel Carousel — was also finished that year at a cost of more than $1 million. (Restorers spent almost 1,000 hours on each fake animal, according to the zoo’s Web site.)

"It’s evident that capital improvements from the bond measure focused on visitor amenities, not improvements for the animals," the report states. "The Joint Zoo Committee and Recreation and Park Commission did not provide adequate oversight to ensure capital improvements made with bond money focused on animal enclosures and exhibits."

The report also points in part to a 1999 performance audit of the zoo conducted by San Francisco’s respected budget analyst, Harvey Rose. The audit at that time argued that improving animal exhibits should come before building new gift shops and dining facilities, but that this recommendation was "not heeded," according to the commission.

"It was clear that none of that had been addressed," Mara Weiss, an animal welfare commissioner and veterinarian in the city, said of the 1999 audit.

Zoo officials received repeated invitations to attend recent commission meetings on the zoo, but they were mostly ignored. Weiss, however, acknowledged that the zoo was distracted by the tiger attack and resulting media circus.

‘UTTERLY IMPOVERISHED’


Early this year, three zoo experts from abroad visited the San Francisco Zoo at the request of the group In Defense of Animals. Each sent a letter to the supervisors that decried the conditions in San Francisco. Robert Atkinson, a former Oxford University conservation, welfare researcher and one-time curator at the Woburn Safari Park in the United Kingdom, noted a failure "to adopt modern approaches to animal husbandry." Peter Stroud, a former zoo director from Australia, described the Black Rhinoceros exhibit as "utterly impoverished."

"It is in fact completely barren…. This exhibit conveys the general impression of a stock yard in which the interests of the animals are of no concern whatsoever," Stroud wrote.

The crown jewel of the zoo’s animal habitations constructed using bond money, the African Savanna, was completed in 2004. It features giraffes, zebras, kudus — a species of antelope — and a bird aviary. But even that exhibit, the welfare commission argues, has problems.

"The new African Savanna exhibit was located in the most weather-exposed part of the zoo, and constructed without shelter or windbreaks for the warm-weather animals displayed there," the report states. "In fact, the most sheltered part of the African Savanna exhibit was designed for the human visitors, leaving the animals who live there exposed to the cold wind and fog off the ocean just across the street."

We tried to reach the zoo for comment, but an administrative assistant told us that spokesperson Paul Garcia recently left his job there and a replacement wasn’t available for questions. Another spokesperson was out of town. We were told that Bob Jenkins, the zoo’s director of animal care, might return our call but he never did.

Jim Lazarus, a former zoo executive and current rec and park commissioner, said the zoo had to devote significant funds to its entrance to comply with the Americans with Disabilities Act. In addition, he said, the cost of construction materials globally has ballooned since 1997.

"None of this money goes as far as originally thought with the worldwide demand for steel and concrete…. We need a multiyear plan, both in terms of priority construction and a capital campaign funding strategy, to complete the half of the zoo that hasn’t been renovated and that should be our goal," Lazarus said. "It’s a wonderful facility."

But future projects planned for the zoo appear to continue the emphasis on visitors. A wish list of projects from the zoo’s 2007 master plan update includes adding new conference spaces and retail, improving areas for family activities, creating a 1,000-seat amphitheater, installing yet another new café, and possibly a full-service restaurant called Windows on the Pacific.

The commission, however, has proposed that the zoo become a haven for saving animals rather than simply exhibiting them for the enjoyment of people. A rescue zoo, as they describe it, would provide a new home for exotic animals once held by private owners in inhumane conditions. Zoo veterinarians and other staff already possessing experience treating sick animals would naturally fit into the new concept, and the zoo’s past conservation efforts, like programs for eagles and wild cats, could be grandfathered in.

Deniz Bolbol, a co-coordinator of the Bay Area–based Citizens for Cruelty-Free Entertainment and supporter of the rescue zoo idea, describes the joint committee that oversees the zoo as a rubber stamp and says, "everything the zoo proposes is approved; everything is unanimous."

"The Board of Supervisors really needs to reform the zoo at its base," Bolbol said.

Lazarus opposes the idea of a rescue concept because he believes it won’t generate enough revenue to keep the zoo self-sufficient. Sup. Sean Elsbernd, whose district includes the zoo, was also cool to the idea, saying no one has an idea of how much it might actually cost. Discussions at the board about how the $48 million in bond money was spent, in the meantime, would likely take a back seat to the lingering citywide $338 million budget deficit.

Besides, he said, the zoo’s new Grizzly Gulch, where two bears that were close to being euthanized by Montana wildlife officials live, represents what the commission is asking for.

"In concept, it’s a great idea," Elsbernd said. "In concept, I also support every street being repaved every year. But there’s reality. There was no realism in their report that showed us how to achieve [a rescue zoo] in the means that we have."

The operating agreement between the Zoological Society and the city comes up for renewal in June.

Endorsement: Barry Hermanson

Let’s not fool ourselves: Jackie Speier, the former state senator from San Mateo County, will be replacing the late Tom Lantos in Congress. The odds are pretty good that she’ll emerge with enough votes in the special election April 8 to take the seat immediately, and she’s bound to win the Democratic primary in June and get elected to a full term in November.

And that’s not a terrible thing. Speier’s an experienced legislator, was a solid advocate for consumers and for privacy rights in Sacramento, and is already better on the war than Lantos was. Speier told us that she favors immediate troop withdrawal, and that she would was unlikely to vote for any more appropriations for the war unless the money was earmarked for drawdown and withdrawal activities.

But on a lot of issues, she’s something of a disappointment to progressives in the district. She talks about single-payer health care, but wants to keep the private insurance companies in the picture and she talked a lot to us about forcing consumers to limit medical expenses to contain costs. She wasn’t willing to commit to seeking to overturn the privatization of the Presidio and she supports Don Fisher’s plans to build a private museum there. Although she wants to let the Bush tax cuts expire, she was very, very shaky about raising taxes on the very rich (even capital gains taxes). When we asked her what she would do about preventing the financial-services mess that created the home mortgage crisis, she only said she would be “more willing to support an increased regulatory environment than not.”

In other words, she’s promising to be a mainstream Democrat who’s unwilling to push the edge on a lot of issues that people in her district care about.

So, if only as a protest vote (and to remind Speier that she has to be accountable to the progressives) we’re backing Green Party candidate Barry Hermanson.

Hermanson, who for years ran a small business in town, talks openly not just about ending the war but about dramatically cutting defense spending, which, he points out, sucks up more than 60 percent of the entire federal discretionary budget. He’s for government-run single payer, for tighter regulation of the financial sector and for a massive public investment in infrastructure and green technology.

Michelle McMurry, who is running as a Democrat, is a physician, a smart and articulate person with a thoughtful approach to health care. We’d love to see her stay active in politics, but she needs a bit more seasoning before she’s ready for Congress.

So we’ll go with Hermanson in the April 8 special election.

Bureaucrats blow $375k reading Matier & Ross

Employees working for the city and county of San Francisco have squandered $375,000 in salaried work hours over the last 12 months reading San Francisco Chronicle columnists Matier & Ross, time that could have been spent finding cheaper ways to provide a police presence at political demonstrations and repaint parking garages located at far-flung BART stations, according to a new report by Controller Ed Harrington.

“Our analysis shows that City Hall staffers spent precious work time reading about how wasteful they are when they could have been figuring out how to make the board’s chambers ADA compliant for less money or more quickly dispatch frivolous and costly lawsuits against the city,” Harrington said.

The report shows that overpaid City Hall staffers in particular devoted seemingly endless salaried hours reading about how they and their colleagues have burdened San Francisco’s already bloated $338 million budget deficit and how Jerry Brown’s recent office redo in Sacramento cost a whole lot of taxpayer money.

“Dude, I’m totally expensive,” said one City Hall insider after reading about how much it cost for him to have a big title but few actual tasks. “And holy shit, did Don Perata’s new taxpayer-subsidized car really cost that much? No wonder we’re laying off teachers.”

Chop from the top

OPINION San Francisco officials released two very different documents last week. The first was a list of the 596 city employees making $150,000 a year or more in base salary. The second was a letter to the 334 patients of the Chronic Care Public Health Nursing program informing them that as of April 15 they will no longer have a public-health nurse helping them manage their illnesses.

You might expect that when the mayor proposes an "across the board" budget cut from city departments because of a looming budget deficit, almost any position in city government would be on the table. You might expect that maintaining services to the most vulnerable city residents would be a priority. But according to these two documents, you’re safe if your salary is $150,000 or more, and you are abandoned if you are poor, frail, and chronically ill.

Last week, Board of Supervisors President Aaron Peskin suggested that instead of just cutting from the bottom, the city also consider cuts at the top. "So let me understand," the Chronicle quotes District Attorney Kamala Harris (No. 55 on the top-earners list), "Aaron Peskin is basically saying we should eliminate all the doctors and lawyers who work for the city."

But Harris didn’t understand. Peskin isn’t proposing to cut all of those 596 positions. He is proposing that in a fiscal crisis, the agenda should include some cutting from the top, not just the bottom.

As a public health nurse in the program slated for closure, I’ve been working to treat and make plans for my patients during the day, while working at night to keep the program open. I’m not worried about my job: nurses are in high demand and there’s comparable pay in many private hospitals. But private health care rarely serves the people I’ve come to know doing this job for the past year: frail, uninsured elderly folks with no families; patients who face language and literacy barriers who can’t navigate the system and use emergency rooms when they feel sick; long-time residents of Laguna Honda Hospital coming back to the community not knowing how to use a cell phone, let alone monitor their diabetes.

As the number of chronically ill people skyrockets, along with the costs of caring for them, it would seem a no-brainer to fund a group of nurses who are experts in keeping those folks out of the hospital. But our health care system still operates on an acute-care model. While Medi-Cal will pay the city much of the expense of sending a nurse to do brief wound care for a diabetic, it pays much less for a nurse to keep that same person healthy enough to avoid the next wound. Calcuutf8g future savings from chronic care health services is hard. So on paper at least, it’s a money-saver, if not the moral choice, to close the program.

When I was in nursing school, my public health professors told me, "in Public Health, you have to be an advocate, because your patients can’t be." But I bet those 596 top earners can defend themselves — and Peskin is right, some of them should be given the opportunity.

Sharing the pain

EDITORIAL We’re generally not for cutting employee salaries to address the city’s budget deficit. And we’ve never been fond of claiming that doctors and lawyers who earn less-than-market wages working for the city of San Francisco should be penalized because they earn what appear in newspaper stories to be fat paychecks.

But Sup. Aaron Peskin was not on the wrong track when he suggested, only slightly facetiously, that Mayor Gavin Newsom ought to be looking for high-paid staffers to cut instead of slicing services for the poor. Peskin’s point was not so much that the top layers of city bureaucracy were outrageously overpaid (although a few of the mayor’s aides and some of the department heads he’s hired could fit in that category) but that all of the cuts have come at the bottom. Find 10 surplus bureaucrats making $150,000 a year and you could save the entire program that provides public-health nurse visits for chronically ill San Franciscans.

Sure, some of this is politics: Newsom is taking a stab at the mayor with a suggestion bound to win popular support. But it’s also a serious policy issue: when the city’s in the red, where should the burden fall? In Newsom’s current budget proposals, it falls almost entirely in the wrong places.

Eliminating a deficit of more than $300 million is daunting. Of course, the city wouldn’t have this problem if Newsom and his predecessors had been willing to look at obvious (and flexible) sources of new revenue. Public power alone would’ve brought in almost enough to cover this year’s shortfall (and would have earned the city so much cash during the better years that it could have been set aside in a rainy-day fund to prevent these kinds of budget roller-coasters). The city’s major taxes are a regressive mess; fixing the business tax alone (and making it more progressive) would help the economy and allow the city to raise cash from those most able to pay.

In other words, instead of axing nurses who help sick and housebound senior citizens, Newsom ought to be looking for money from the wealthy.

But right now, the mayor is talking only cuts — and for the most part, only cuts of lower-paid, front-line workers. The least the mayor could do is make a good-faith effort to share the pain. Looking for 10 useless high-paid execs in order to save public health nursing? How about former Sup. Bill Maher, who earns $144,838 out at the airport, where the last time we checked (see Here’s Bill; 5/26/06) he hardly ever showed up for work? Nine more patronage cronies, Mr. Mayor, and you’ll make the nut.

The price of gold

Five years ago, the overseers of San Francisco’s iconic Golden Gate Bridge were facing a $454 million budget deficit. That figure was larger than the gross domestic products of East Timor, the west African country of Gambia, and the Independent State of Samoa.

Investigative reporter Thomas Peele of the Contra Costa Times decided to try and figure out how a bridge in the United States could amass a funding shortfall that dwarfed the economic output of entire nations. For one, he reported in a 2002 story, the Golden Gate Bridge, Highway, and Transportation District used money from the tolls paid by motorists to bankroll an expensive transit system that includes a network of buses in Marin County and a fleet of ferry boats that collectively cost millions per year to operate.

Peele also discovered that the bridge’s 19-person board of directors, some members of which live far from the Bay Area, spent more than $56,000 over a two-year period just to cover trips — including meals, rental cars, and hotels — to regular meetings at the Golden Gate’s administrative offices in San Francisco.

The embarrassed district promised reforms and vowed to get its economic house in order.

But five years later, we’ve learned, very little has changed.

The district touts its substantial cuts in overhead, insisting everything possible has been done to avoid raising the toll on motorists. But the Golden Gate Bridge District’s financial problems aren’t going away — and the only solution the administration can come up with is perpetual toll increases.

Even that answer poses huge problems. The bridge doesn’t expect that the actual volume of toll-paying motorists, or the ridership on its buses and ferries, will rise in the near future at the same pace as its expenses, which are largely consumed by employee salaries, benefits, and other perks that the district’s hundreds of workers, including its board members, enjoy.

Public records show today that the district pays for health insurance for 14 of the (very) part-time directors. Last year alone, that insurance combined cost $48,000 — even though several of the board members, including two mayors and four county supervisors, are already eligible for insurance coverage in their home counties.

The bridge district’s projections show vast deficits stretching off into the next decade — and if the problem isn’t solved, a public transit system will be at risk. Riders, among them a high number of business commuters, make 9.4 million annual trips on Golden Gate’s transit system. If the fiscal mess continues unabated, the board will either have to hike tolls to larger numbers ($10, $15, $20?) or start cutting back on the buses and ferries.

The only alternative, says Golden Gate board member and San Francisco supervisor Gerardo Sandoval, may be to ask state lawmakers for the right to change the district’s charter so it can raise money a different way, such as through sales or parcel taxes.

But many of the board members, who benefit from the lucrative sinecure and the power of this bureaucracy, don’t want to take that risk. "Their fear is that if they go to Sacramento, no one’s going to ask them their opinion," Sandoval told us. "The end result is going to be some legislation that significantly changes the way the bridge is run."

BUY A BIB, SAVE A BRIDGE


Bridge officials say the projected deficit was a lot worse five years ago, before they instituted cost-cutting measures. The biggest cuts came in the form of eliminating nearly 200 positions, about a fifth of the workforce. The district also instituted a hiring freeze and forced workers to negotiate wage rollbacks and share more of the costs of their medical coverage.

Bus services from the district’s fleet of 200 were reduced by 22 percent in March and November of 2003, and taking a bus from Marin to San Francisco now costs 34 percent more than it did five years ago. The weekday fare for a ferry from Larkspur to San Francisco was raised a whopping 118 percent, and available ferry seats were reduced 23 percent by cutting trips. It can cost between $7 and $8 one-way to ride Golden Gate’s ferries and buses today.

But over the next five years, the district still anticipates its deficit will reach $91 million.

So after raising the toll five years ago, bridge officials want to do so again as soon as September. Motorists would pay $6 in cash, $5 if using a FasTrak prepaid device, and $3 instead of $1.50 for disabled drivers.

"It seems pretty clear that the [bridge’s] staff is driving the board of directors, and not the other way around, toward infinite toll increases," Sandoval said. "It’s a ludicrous idea, but that’s the only one they have right now."

Earnest bridge staffers point out in reports prepared for the public that they’ve implemented "revenue enhancements," such as putting out a donation box for visitors who might be willing to give up some pocket change and creating special sales programs at the gift shop.

Online trinkets for sale have even been expanded. At Goldengate.org you can purchase a piece of the bridge’s original cable for $175 or an $8 baby bib that reads "Golden Gate Bridge: Big, Strong and Awesome, Just Like My Dad."

But that’s not going to add up to $91 million.

Meanwhile, the anticipated deficit doesn’t even include capital projects like the nearly $185 million the district wants to spend overhauling and replacing its buses and ferries, or the $36 million it hopes to spend over the next 10 years deterring suicides, which are perhaps the second best-known feature of the Golden Gate Bridge after its aesthetic beauty.

And, of course, the bridge constantly needs repainting, thanks to the wind and salt air. "There’s more [required] maintenance on the Golden Gate Bridge than any other bridge in the country because of where it’s at…. It has to be looked after everyday by a crew of ironworkers and painters and whatever else is needed," said board president John Moylan.

The district’s largest operating expense involves paying the remaining 836 full- and part-time workers at the bridge and granting them fringe benefits like insurance coverage and supplemental pensions. This year alone salaries and benefits will cost about $100 million.

THE RED INK MOUNTS


About 60 percent of the district’s budget goes toward keeping its ferries and buses running, but key performance measures show that Golden Gate’s transit system does poorly in three crucial areas, including cost efficiency and effectiveness. When compared with national averages, Golden Gate Transit has one of the top five highest operating costs per "vehicle revenue mile" — a barometer of efficiency — out of the 150 largest transit agencies nationwide, making it more inefficient than BART, AC Transit in Alameda County, and the transportation authorities in Santa Clara and San Mateo counties, according to 2005 figures maintained by the federal Department of Transportation.

It’s common for transit systems to rely on government subsidies, and few environmentalists have sympathy for drivers who whine about toll increases from the comfortable interiors of their automobiles. Mass transit is the future of urban living.

"The Golden Gate Bridge may not be as efficient as other comparable systems," Sandoval said, "but if we abandon the investment we have made in mass transportation, it will really leave us with poor options in the years to come."

Alan Zahradnik, Golden Gate’s director of planning, adds that the bridge’s buses and ferries are dissimilar to other transit systems around the country because they tend to carry fewer commuter passengers over greater distances mostly during peak hours compared to transportation authorities like San Francisco’s Muni and AC Transit.

"It’s more expensive to provide suburban, fixed-route transportation," Zahradnik said.

Nonetheless, without an increase in the toll for motorists, the bridge expects to sustain annual deficits for each of the next 10 years until the red ink reaches $290 million.

So it would seem that if the district is asking everyone to tighten their belts, its board of directors should probably do the same. The extraordinarily large 19-member Golden Gate board contains more than twice as many directors as the seven-member board that oversees Muni’s trains and buses and the nine-member board that governs BART.

That’s a throwback to history. When the bridge district formed in 1928, several counties north and south of the span were asked to participate in the $35 million bond issue required to construct a road across the Golden Gate, and although the bonds were paid off decades ago, each of those counties still receives representation on the board.

"There have been attempts to topple the bridge district in the past, but they’re so hard-wired, it’s been impossible," said Susan Deluxe, a Tiburon resident and long-time critic of the district.

The list includes two counties located far to the north, Mendocino and Del Norte — the latter bordering Oregon. But the board’s structure hasn’t been tinkered with since its formation.

When asked whether the far-flung board has outlived its usefulness, the representative from Del Norte County, Gerald Cochran, explained that the distant jurisdictions help diminish tension between the representatives from San Francisco and Marin, who frequently argue over who should contribute more to maintain the bridge. Besides, he said, Del Norte stepped up to help make the Golden Gate Bridge happen in the first place.

"It’s not what we do today," Cochran said, "it’s what we did 75 years ago to get this bridge built. We make our contributions."

The travel expenses of the two directors representing Del Norte and Mendocino counties were the highest board-meeting travel costs he found back when Peele first reported on the board’s budget — $42,404 to cover trips from their home counties to San Francisco for regular board meetings over two years.

In 2002, bridge officials told the public that the district’s top-heavy administration would spend less along with everyone else to save money. The newest $6 toll was proposed "with the understanding that staff will continue to focus on finding internal cost savings," one staff report promised.

But that’s not exactly what new numbers we obtained from the district through a public records request show. Transporting distant directors to district meetings over the past two years cost more than $54,000.

Exasperated district staffers respond that travel for board members to conferences around the globe has already been trimmed and the number of regular meetings they hold in San Francisco were cut to save on the $50 stipends board members traditionally earned per meeting for serving.

A HEALTHY PERK


A majority of the directors receive health insurance coverage from the district, either Blue Shield or Kaiser — a perk that few other part-time boards in the state offer. Last year, that cost $48,000.

But many of the directors already receive coverage from plans in their home counties. The bridge paid $1,200 last year to cover Mike Kerns; he is also a Sonoma County supervisor, where he’s on a second plan that includes life, dental, vision, and health coverage — and costs taxpayers there about $63,000 annually, the clerk of Sonoma County’s board told us. Kerns was on vacation when we called his office at press time.

Board member Albert Boro receives health insurance through the bridge, but taxpayers in San Rafael, where he’s the mayor, pay an additional $19,000 annually to cover him there, according to figures provided by San Rafael’s city manager.

But Boro told the Guardian that the bridge coverage is "secondary and it’s only utilized when my primary doesn’t cover something…. It’s not a premium in the sense that it might be through the city [of San Rafael]."

Three San Francisco supervisors participate in the plan offered here for county employees, which annually costs taxpayers approximately $10,500 per person, according to the controller’s office. But the bridge also covers those individuals. The list includes Tom Ammiano, Jake McGoldrick, and Gerardo Sandoval and costs a total of $14,000 to cover all three of them, according to district numbers we requested.

Ammiano said the benefit could be done away with if it truly became a burden on the bridge’s budget. "That would take the will of the board," he said. "[Doing away with it is] not something I would be against, but I can only speak for myself."

Board director Bevan Dufty, also a San Francisco supervisor, declined to sign up for the coverage when he joined the bridge’s board in 2005.

"I had insurance and it seemed duplicative to me … I meet with people every day who don’t have insurance from all walks of life and so I felt fortunate," Dufty said.

Only about 12 percent of the 450 or so special districts that responded to a survey two years ago asking about health coverage said they offered such benefits to their directors or trustees, according to Neil McCormick, head of the California Special Districts Association. The group represents around 900 waste management, utility, fire, and recreation districts across the state. The Golden Gate district is not a member.

The real problem here is that after the district retired its bond debt in 1971, it never came up with an adequate revenue source to cover all of its operating or capital costs. Bridge officials never sought from state lawmakers a mechanism, for instance, to borrow money at a fixed rate, like school districts do.

So what will the bridge do in five more years? Nobody seems to know. According to San Francisco board member Janet Reilly, "That’s the $64,000 question…. There’s only so much toll tolerance among drivers."

Bye-bye, Buster’s

Despite the clear need for a 24-hour drop-in center for homeless people to get off the streets and out of the elements, Buster’s Place was still put on the bloody budget block and closed its doors yesterday at 5 p.m.

For weeks, staff at Buster’s have been counseling the 150 to 200 people they see everyday on different places to go. 150 Otis is the city’s stated stand-in for Buster’s, run at half the cost and only open to half the population – the male half. Women are being told to go to Oshun, but resources at that 24-hour drop-in are already stretched thin.

Jennifer Friedenbach, executive director of the Coalition on Homelessness, was on the scene last night. She reports: “At least 20 people were filed out the door. Four of them were in wheelchairs. Many were elderly. Not one that I talked to had anywhere to go. There was no one from the city, not one person – not the homeless czar, not the Homeless Outreach Team, not the Department of Public Health – to assist them. Many filed over to 150 Otis to try their chances at a bed for the night in the CHANGES system, but the shelter had not opened yet.

“One woman I talked to was in a wheelchair and looked to be in her early 90’s. She was rolling slowly away, and said she had somewhere to go. When I asked her where, she clearly had no idea and was very confused. She had nowhere to go, and I did not see her in line at 150 Otis, where being female, they would not have given her a number to hold her place in line anyway.”

The sign on the door speaks the truth to the 200 people who pass through it everyday: "Buster’s Place/13th Street Drop-In will be permanently closing Monday March 31 at 5 p.m."

Will, a trim, soft-spoken man seated inside Buster’s on a Monday afternoon, reading a paper and waiting for his laundry to finish spinning, says that starting April 1, "The street is going to be where I go. The Safeway sink is going to be my shower."

Buster’s Place, a homeless services facility run by Haight Ashbury Free Clinics, is on Mayor Gavin Newsom’s midyear budget chopping block. But recently passed legislation says the city must provide a 24-hour drop-in center accessible to anyone. On March 18, the Board of Supervisors, by a vote of 9-2, passed "standards of care" mandating that all city-funded homeless shelters meet a basic level of sanitation and service, stocking facilities with toilet paper, soap, and nutritious food, as well as keeping at least one open 24 hours a day for anyone to walk in the door. (See "Setting Standards," 1/30/08 and "Shelter Shuffle," 2/13/08.)

Newsom tacitly supported the new law, but took issue with the $160,000 price tag — which does not include the $1 million it takes to run Buster’s for a year.

The Human Services Agency plans to temporarily fill Buster’s void with 150 Otis, a city-owned building across the street where storage and shelter reservations are provided for homeless people. In the past, it’s been an emergency shelter for men, but it is only permitted to operate nine months out of the year. On April 1 it will reopen with about 30 beds and 30 to 40 chairs — all for men — and will only be open until June 30, the end of the fiscal year. HSA did not respond before press time to multiple requests for more details on the plan.

Beyond trying to fix a permanent problem with a temporary solution, 150 Otis will be a shadow of Buster’s.

"Buster’s definitely handles more than 30 to 40 people a night," said the Department of Public Health’s David Nakanishi. On March 20, for example, Buster’s staff reported to Nakanishi that 98 people were on-site at 3 a.m. — 90 males and eight females. They also reported 30 people at 3 p.m. and 80 at 8 p.m.; 90 was the average between midnight and 7 a.m. Overall, the staff sees 150-200 people a day.

The drop-in center is often the first place a newly homeless person goes for help. But now those people — especially women — will have one less option.

Buster’s manager, Carolyn Akbar, has been telling clients to go to the Free Clinics’ Oshun Center, which has 24-hour drop-in services for women. But, she said, "A lot of women don’t like to go there because it’s right in the heart of the Tenderloin."

Funding for 150 Otis is coming from an HSA budget surplus. "They’re not saving any money. They said as much at the budget hearing," said Sup. Chris Daly.

Already, other city-funded facilities are feeling the strain of one less helping hand. The Mission Neighborhood Resource Center has many of the same services as Buster’s, but is only open weekdays and already operating at capacity. Still, "I’m seeing my numbers spike up," said director Laura Guzman. Contracted to serve 100 people a day, her staff tries to keep the number under 200, but lately it’s been closer to 250. "We had an incidence of violence last week as a result of more people in the facility," Guzman said. Guzman called drop-in facilities "critical players in our system of care. "When everything else fails, the drop-in is there."

Necessities like showers, laundry, restrooms, telephones, and access to medical and dental services can be found at Buster’s. Also, unlike any of the 15 other city-funded places for homeless people, it’s open 24 hours a day, seven days a week, and is "low threshold," meaning there are no basic requirements to come in.

Nakanishi listed several reasons why a drop-in center aids in overall public health, from preventing deaths on the street to providing a place to take a shower and use the bathroom. A Request for Proposals put out by DPH to continue the 24-hour drop-in services next year is also on hold, shaving a slim million from the city’s budget.

Tenderloin Health, which operates a drop-in center on Golden Gate Avenue, was one of the respondents to DPH’s RFP for a 24-hour center and said it was more than willing to extend operating hours past the current 11:30 p.m. closing time.

"The funding was pulled the same day we submitted the proposal," said Colm Hegarty, director of development for the nonprofit. "We would do it. Our proposal was very specific."

Drop-in centers have been criticized as places where people hang out and avoid the shelter systems and services they provide, but that was never the intention for Buster’s, which has only been open for 13 months. "The program was designed to really have around the clock case management," said Nakanishi, who wrote the RFP.

Akbar said Homeless Outreach Team officers were supposed to be working with center staff to move people deeper into the care system, but she’s been told they’re too busy working with people on the streets.

Which is what Buster’s is all about. Most of the people still on the streets aren’t interested in doing something to change their situations, points out Keith Bussey, deputy director of integrated health services for the Haight Ashbury Free Clinics. "But people who come into a drop-in are in that pre-contemplative stage of change. They’re venturing inside for maybe the first time."

Will is unequivocal about Buster’s proposed replacement: "Not 150 Otis. I don’t want anything to do with 150 Otis because of the people who work there." Claiming he’s received rude treatment there too many times, Will even stopped using the storage facility there. Middle-aged and homeless in San Francisco for the past couple of months, he sleeps outside and after two stays in the city’s shelters said, "Never again."

"Ultimately it’s going to hurt the city," said Hegarty of the closing. "You’ll see more of a presence on the streets. People will want to see something done about it, so there will be more police responding. The criminal justice system is going to become burdened. The emergency room at San Francisco General is going to become burdened. People will go anywhere they can just to get off the streets."

Stop the Cow Palace land grab

EDITORIAL Technically, the Cow Palace isn’t in San Francisco, but it’s part of the larger city’s history. It was the site of two historic political conventions, a string of historic concerts, and lots of less memorable smaller events. It’s home to the Grand National Rodeo. For a lot of people who care about links to the city’s past, it’s a treasure. For the half-million or so folks who pass through the doors every year, and the dozens of promoters who use the cavernous hall for expositions, shows, and performances that don’t fit anywhere else, it’s an invaluable part of the local cultural scene.

For people who worry about earthquakes and catastrophes, it has immense appeal — the place could serve as a gigantic shelter, with beds, showers, a huge parking lot for staging, and room to land helicopters in the event of a disaster.

To real estate developers, it’s a potential gold mine. And to Daly City, where the Cow Palace sits, it’s an opportunity to create a huge new complex of condos and retail stores that would bring in millions in new taxes.

So when state Sen. Leland Yee introduced a bill that would force the state to declare the Cow Palace surplus property and sell it to Daly City, the battle lines were drawn. A front-page story in the San Francisco Chronicle suggested that the venerable place could be razed for redevelopment. Supporters have come forward to talk about its role in the community and its value as a venue. The Daly City manager, Pat Martel, argued that the place gives her city nothing whatsoever in terms of taxes and hosts some events — like a gun show and the Exotic Erotic Ball — that her constituents find offensive.

What’s missing from most of this debate is the fact that this is 68 acres of prime real estate that’s still publicly owned. Declaring it surplus would almost certainly lead to the privatization of an immense block of potentially priceless urban land.

Yee’s bill, SB 1527, is just the latest chapter in a battle over the Cow Palace that goes back several years. The board that oversees the facility, which reports to the state Department of Agriculture, has been negotiating with Daly City to lease 13 acres of parking lot and underused land for development. That would allow the city to build some new housing, seek a supermarket that the neighborhood badly needs, and add to the local tax base. But the talks have stalled — and after Daly City hired powerhouse lobbyist and former assemblymember Bill Duplissea to take the case to the Legislature, and Daly City’s council asked for help, Yee stepped up.

SB 1527 mandates that the state sell the property to Daly City, with the proceeds going to pay off some of the debt the state incurred through the governor’s misguided deficit-recovery bonds. Yee argues that the state needs the money in this brutal year to save public education, and we understand how powerful that message can be — but selling off public land to cover budget shortfalls is almost always a terrible idea.

There’s little doubt what the endgame is here: Daly City doesn’t have the cash to buy 68 acres that will be worth hundreds of millions of dollars at fair market value. All the small municipality will be is a conduit — the land will be quickly flipped and sold (or leased for very long terms) to private developers.

The Yee bill is designated an "urgency measure," which means it could be approved as early as April. That’s ridiculous; there is no urgency here. This is a huge decision, and needs a lot more public discussion and debate.

We suspect that there’s a way to meet Daly City’s needs for development without turning over the entire 68 acres. There’s almost certainly a way for the Cow Palace to remain and for some of its land to be used for housing and retail.

But we haven’t even seen a template for what sort of project would go on the site. How much of the housing would be affordable? How much of the retail would serve the community? Would this become another chain-store-and-luxury-condo site with gated homes in an economically depressed area? What will the San Francisco neighborhoods that border on the site get out of it? Will there be any new parkland or open space? How will a large commercial complex there affect traffic, noise, pollution, displacement, and other environmental factors in the surrounding areas?

How on earth can you talk about selling off such a huge chunk of public land without even talking about how it will be used?

This is nuts. Yee’s bill needs to be defeated, and all the parties (including the San Francisco city planners and supervisors) need to start cautious, long-term discussions about the Cow Palace, its land, and the needs of the public. Otherwise this will appear — with justification — to be nothing but a sellout of gargantuan proportions.

Anyway you cut it, the city budget deficit is going to be painful

Sup. Chris Daly failed to save Buster’s Place from the budgetary chopping board today—a quest Sup. Tom Ammiano deemed “a Sophie’s Choice,” since it involved disappropriating funds that had been earmarked for making the Board’s Chambers wheelchair accessible.

“But I applaud Daly for trying to do an Immaculate Conception, a Hail Mary to make it work,” said Ammiano, as he joined Sups. Sean Elsbernd, Sophie Maxwell, Jake McGoldrick, Carmen Chu and Bevan Dufty to defeat Daly’s plan.

But by meeting’s end, the homeless weren’t the only ones feeling the city’s budget pain. Hundreds of highly paid city employees were surely chewing their nails, following Board President Aaron Peskin’s announcement that in light of the city’s $338 million deficit, he is drafting an ordinance to eliminate all base salaries over $150,000.

596 city employees make over $150,000 a year, according to the Controller’s Office.

But while the MTA’s Nathaniel Ford tops the list ($297,999), with the Retirement System’s David Kushner ($289,478) and Administrative Services’ Amy Hart ($264,524) in second and third place, followed by the Airport’s John Martin ($256,565), Controller Ed Harrington ($256,553) and DPH’s Dr Mitch Katz ($256,553), don’t expect them to be laid off any time soon.

You can try dealing with the deficit with lots of little cuts from the bottom up.

As Peskin told the Guardian, the Board is not allowed to tinker with some positions, because of charter mandates.

“Some people are constitutionally protected, such as department heads,” Peskin said, “and Proposition D arguably protects police personnel who make over $150,000. And others are doctors at San Francisco General Hospital.”

But beyond those restrictions, a lot of folks could be standing in Peskin’s potential firing line.

“All of them, regardless of pay, perform an important function in the government,” Peskin observed, “but rather than do what the Mayor is doing and make 8 percent across-the-board cuts, we’re making sure that the most vulnerable people don’t get hurt.”
“And we don’t need public information officers in every department,” Peskin added, noting that their elimination would save the City about $50 million a year.

Or try attacking the problem from the top down.

Peskin admitted that the police, fire and nurses MOUs, which Mayor Gavin Newsom negotiated last summer in the run up to his 2007 mayoral reelection, explain a large part of the City’s 2007-2008 budgetary woes.

“We are all to blame for that. The Board signed off on them, I’m not going to pretend we didn’t,” Peskin said, observing that this month’s axing of Buster’s Place and the Workers Compensation Clinic are “just the tip of the iceberg.”

“Come the Mayor’s budget, we’ll be crying over much larger things,” Peskin explained. “That’s why we need to take some radical steps now to lessen the impact.”

Monique Zmuda of the Controllers Office told the Guardian that the City will need to determine if the functions performed by folks who make over $150,000 are “mandated”. From the remaining sublist, Peskin will have to decide, “if he is truly intending to delete those jobs,” said Zmuda, noting that many of the remaining positions are lawyers, and that “it’s not Peskin’s intention to stop city departments from being able to do business.”

Pointing to the 8 percent cut that the mayor asked of departmental baseline budgets last November, and the additional 8 percent personnel cut that Newsom just announced, Zmuda said, “Peskin’s request means the Boad has additional options to consider, that it’s not just reacting to the Mayor’s proposal. If we have a $338 million gap, it’s better if the options add up to more than that, so that the Board can pick and choose and decide what is the highest priority to save and to cut.”

Or as Sup. Jake McGoldrick told the Guardian” I think Peskin is trying to invigorate a dynamic dialogue and debate.”

In other Board-related news, the Olympic Torch debate continues to burn.
As protesters chanted ‘Mayor Newsom reject China’s bloody torch” outside City Hall, Sup.Tom Ammiano introduced a resolution urging the Mayor, the Mayor’s Office of Criminal Justice and the San Francisco Police Department to comply with the City’s Sunshine ordinance and immediately release the route of the April 9 torch run, along with other documents that the American Civil Liberties Union of Northern California requested on March 13.

And Board President Aaron Peskin sent Supervisor Chris Daly’s resolution, which proposes to accept the Olympic Torch with “alarm” in light of China’s Tibetan crackdown, to the Rules Committee this Thursday.

We hope. We really hope. After nearly two years of collaboration from a variety of homeless service providers, city officials, and activists, the standards of care legislation for city-funded homeless shelters was finally passed in a quick roll call vote by the Board of Supervisors on Tuesday, March 18.

The legislation is considered a major victory for homeless rights advocates and groundbreaking for homeless programs across the country. The legislation, sponsored by Supervisor Tom Ammiano and co-signed by Supervisors Ross Mirkarimi and Gerardo Sandoval, was initiated after investigations by the city’s Shelter Monitoring Committee found many shelters lacking in basic hygiene products. Over half of shelter residents reported some form of abuse during their stays. Key components of the legislation require shelters to provide toilet paper, clean sheets and towels, sanitary bathrooms, and eight hours of sleep a night.

Over the past few weeks the legislation has caused some tension between Supervisors and supporters of the bill and the Mayors office. One of the biggest points of contention was the pricetag of the legislation, initially ballparked at $6 million by the Budget Analyst’s office. However, members of the Standards of Care work group, which wrote much of the legislation, argued the estimates were far too high. In fact, the final bill passed with an estimated $165,000 per year cost to the city.

The legislation also includes a mandate for a 24-hour drop-in center, another departure from Mayor Gavin Newsom’s fiscal priorities. In his recent mid-year de-funding spree, the Mayor pulled Buster’s Place, the city’s only centrally located 24-hour drop-in center. Read this if you want to know why Buster’s is often the only places to go if you’re looking for a shelter bed. While the legislation requires a 24-hour center, it is not clear who will run the center and where.

Supervisors Carmen Chu (District 4) and Sean Elsbernd (District 7) were the only supervisors present who voted against the legislation. Both were appointed to the Board by the Mayor.

Half a decade of war

EDITORIAL Five years ago, the antiwar movement shut down San Francisco. It was a moment in history, one of those times that those of us who were there will never forget. No cars on Market Street. No cars on Mission Street. No business as usual anywhere downtown. Just a powerful statement that the city was not going to pretend that invading Iraq was an acceptable move.

And yet, for five years, the war has gone on. Sometime this spring, it’s likely the total number of American soldiers killed in the pointless military adventure will pass 4,000. And that’s just a fraction of the carnage: according to iraqbodycount.org, more than 89,000 civilians have died since the George W. Bush administration launched the invasion in March 2003.

There will be any number of newspaper stories, special reports and anniversary programs in the next few weeks, but of all the facts and statistics they’ll cite about the war, one ought to be at the top:

The antiwar movement was right.

Everything that the activists in the streets (and the very few newspapers that supported them, like this one) said at the time would prove to be absolutely true. As Steven T. Jones notes on page 14, there were no weapons of mass destruction. There was no link between Saddam Hussein and al-Qaeda. Iraq had nothing to do with Sept. 11. United States troops were not welcomed as liberators. There is no functioning Iraqi democracy. The situation in the Middle East is more unstable now than it was five years ago. Nothing has come of this war except disaster, death, and a bill to the American people that could reach $3 trillion.

In fact, Bush’s war is one of the main reasons that the economy is such a mess today — and that’s something the Democratic presidential candidates need to be talking about.

There has been nowhere near enough debate over the cost of the war. Bush has managed to fund the entire effort through supplemental appropriations, without once presenting a full budget to Congress. And the Democrats, fearing political criticism if they cut funding to troops who are in harm’s way, have gone along with every single spending request.

That’s been a huge factor in the nation’s mounting budget deficits and rapidly growing debt. And unlike deficit spending that funds social and infrastructure priorities, the red ink has done little to create jobs or improve the economy. It’s well known that military spending does less to help economic growth and recovery than any other type of government program. Put another way: If the $3 trillion that will go to the Iraq war were put into any other public venture, it would have tremendous positive consequences for society. It could, for example, preserve Social Security for another entire generation without new taxes or benefit cuts.

But those sorts of choices haven’t been presented to the public, because the war has been sold as a painless effort that requires no national sacrifice. And the bills won’t all come due until this president is gone and his successor has to deal with a deep recession, a horrible budget mess, growing unemployment, and a legacy of international distrust.

The good news is that the antiwar activism has forced both presidential candidates to pledge to bring the troops home — and Barack Obama could be the first president in years to be elected in large part on the basis of a strong grassroots peace movement. But the next president won’t stop the war without continued, constant pressure. It’s easy to think of the antiwar movement as a failure and to get discouraged — but this is not time to let down. If a Democrat wins the White House, visible and organized activism will be more important than ever. And this time, it might actually change American politics.

Freedom of Information: More sunshine — easily and at no cost

Imagine sitting at home — or in your office, or in your favorite café — and listening in on what are now secret, backroom policy discussions and decisions in the San Francisco mayor’s office. Imagine having access to an immediate transcript of the talks. Imagine being able to read internal e-mail discussions among city staffers about issues that affect you — without ever filing a public records request. In fact, imagine never having to file another written request for public documents; imagine just going to a city Web site, entering a search term, and finding all of the records yourself.

Imagine filing a complaint with a city agency and tracking the issue, minute by minute, as it works its way through the system.

Imagine listening on your cell phone to any policy body as it meets in city hall.

All of this is possible, today. Much of it is not only consistent with but actually required by local law. And it won’t cost the city more than a modest amount of money.

Transparency is a common buzzword during this presidential campaign; the Barack Obama campaign has even issued a white paper describing policy and technological ways to embrace it. He’s talking about live Internet feeds of meetings about significant issues involving executive branch appointees as well as for those of regulatory departments (a program that would go far beyond what you see on C-SPAN).

So there’s no reason San Francisco can’t take the lead in using technology — generally simple, off the shelf, existing technology — to dramatically increase sunshine at City Hall and public participation in local government.

Proposition G, the city’s 1999 sunshine law, mandates that San Francisco use "all technological and economical means to ensure efficient, convenient and low cost access to public information on the Internet." Here are five easy ways to do that:

1. Fully adopt the voyeur concept for city meetings. This is the idea that the public should be able to observe and engage in government decision making — all government decision making.

All policy meetings in City Hall should at the very least be broadcast as audio on the Web and available via phone teleconference. In other words, the meetings should be streamed online, and that stream should be accessible by calling a free conference line. This is already standard practice in the business world and is working well for many investors in public companies that disclose financial information in compliance with Securities and Exchange Commission rules. It can be done for little or no cost with services like blogtalkradio.com, skype.com, freeconferencecalls.com, and webex.com.

Today only a limited number of public meetings are broadcast, mostly because the only outlet is SFG-TV and resources are limited. But audio streaming is a no-brainer — there’s no need for a staffer to control cameras, the microphones are already set up, and these days just about every room has a speakerphone.

Currently, the SFG-TV video coverage isn’t posted on the city’s Web site, sfgov.org, until two or three days after a meeting. That’s too long; the audio should be made immediately available online. And the Internet URL and dial-in options should be listed on the meeting agenda so that news media and citizen bloggers can instantly refer back to the URL with timecodes to point out specifics, and include them in their stories and blog postings.

With streaming, you can follow along in real time when you are stuck at home taking care of a sick relative, or at the office listening with headphones, or you are disabled and can’t cross town to attend in person.

The city already has a great contract for real time captioning — the text you see at the bottom of the screen for video. It’s not 100 percent accurate, but it’s pretty decent. That could be expanded to cover streaming audio, and the text could be computer translated (or translated by bilingual typists) into other common languages. The advantage of media integrated with RTC is that specialized search engines like blikx.com and everyzing.com can be used to find relevant phrases and begin playback directly at that spot. And transcriptions can be posted online in real time (somewhat like live blogging!) so that if you are late for a meeting you can quickly scan what has already transpired, and by the end of the meeting you will effectively have a draft of minutes. That saves a lot of staff time and provides an immeasurably more useful historic record.

Today, video recordings of city meetings can’t be downloaded — the only way to review it or post a clip to YouTube is to order a $10 DVD, which arrives a week after you send a check (and no, they don’t take PayPal). And while many other city meetings make audio recordings, you have to pay $1 for an audio tape and pick it up during business hours or pay more for postage. They all should be available as free podcasts.

The SFG-TV video shows more than just the speakers and officials; there are other angles, and they ought to be available too. It’s important to know who attended the meeting but never said anything, who greeted whom, and even who ignored whom.

2. Let the public do the broadcasting. All City Hall meeting rooms should provide wi-fi (and electrical outlets), and the system ought to have enough speed to allow bloggers or activists to upload high-quality video broadcasts of meetings that SFG-TV can’t afford to cover. It can be done using existing services like Justin.tv, Upstream.tv, and live.yahoo.com. This would also allow live blogging — and let people preparing to testify on an issue have access to the Web to do research on the spot. If the room had a projector and a screen, people who were unable to attend the meeting could still comment, either through video or just by posting text messages that the decision makers could read.

The audio broadcasting of meetings should be expanded to include all meetings between the mayor (or supervisors) and city staff. The law already requires public access to so-called passive meetings — those between the mayor or department heads and outside parties that influence city policy.

3. Make public most city emails and other documents as soon as they are produced.

San Francisco city employees produce thousands of records a day — e-mails, memos, reports, etc. — and the vast majority of them are and should be public record. But many are deleted and others never see the light of day. When a member of the public asks for all the records on a topic, just finding those documents can be a sizable task.

But it’s technologically simply to solve that problem: every time a city employee produces a document, the computer system should automatically send a back-up copy to a public web server. That way nothing would get lost or erased, and anyone looking for public information could simply go to that site and search for it him or herself.

For e-mails sent by city staff, one way might be to CC (carbon copy) an online message board (for example Google or Yahoo groups, which would be available at no cost to the city). Other approaches for instant messages, text messages and voicemails could be adopted as well. The Palo Alto City Council is already doing something like this for a narrow collection of e-mails (although not in real time).

We all know there are some city communications that must remain private or be redacted — for example Attorney Client discussions or human-resource conversations regarding personnel. But there are simply ways to make sure those stay confidential: one approach might simply have the user tick a flag or answer a Yes/No Possible Redaction popup when the message is sent. Certain employees — like the people who handle sensitive employee health records and certain litigators in the city attorney’s office — could have software that defaults to a confidential server.

The added advantage, of course, is that the computers could also make a record of the title and date of every confidential document — and that information could be made public. If a dispute arose over whether the city was improperly withholding records, the public would at least know that certain documents existed.

All city files could be stored on network drives (not on local drives) with one location for default public files that would not allow overwriting or deletions and would be mirrored to a Web server and another drive for the few that may require redaction first.

4. Save all the old records. After a very embarrassing lawsuit that is threatening the Missouri governor’s job, that state in January adopted an email retention system that preserves all email for at least seven years (based on federal requirements for financial records). And e-mail/instant message/text/fax retention systems are standard practice now in the financial industry (Morgan Stanley lost a $1.45 billion judgment because the company failed to preserve e-mail).

In fact, we all know storage continues to get cheaper and smaller — so San Francisco should abolish any retention timeframes for electronic records and keep them all into the foreseeable future. The world-famous Internet Archive is right here in the Presidio: I suspect that group would love to archive all the city information, and keep it online, free and forever.

When paper documents are part of the public record, they should be scanned and converted to text and posted within two days. This would include discussions between staff and individual members of policy bodies and the creation of the draft agenda and supporting materials as they are obtained.

All these methods would significantly reduce the number of public records requests to the city staff and thus save the city money.

5. Make calendars public — and keep communications public. Mayor Gavin Newsom won’t provide detailed daily calendars — even after the fact, when there is no possible security reason for keeping his workday itinerary secret. All top officials should post their calendars on the web so the public can track what they are doing.

The city needs to adopt a global policy that city business should be performed on city devices (computers, email accounts, phones) whenever possible — and when city employees or officials use their own computers or hand-held communications tools, those should be forwarded immediately to the city system and made public.

San Francisco has one of the best local Sunshine laws in the country — and at a time when activists at every level are looking for ways to use technology to expand public access, the city should be in the forefront. All it takes is some political will.

Here are some more ways that the city could use technology to improve public access:

1. Use a program like govtrack.us to follow legislative changes.

2. Explore ways to bring nonprofits that perform traditional government services under sunshine laws.

3. Significantly improve the city’s Crimestats system (more real-time allow alerts for crimes near you) – google mashup et al. See http://chicago.everyblock.com/crime/

4. Embrace e-rulemaking technology – similar to federal rulemaking use technology to get ideas online and generate more participation for those who can’t show up in a meeting.

5. Require the Police Department to issue press credentials to bloggers.

6. Fund a few open-government lawsuits to expand the boundaries on access to public records (the law provides for attorney’s fees if the suit is successful).

7. Require city agencies to post the method for obtaining public records online. Require posting of all negative determinations on home pages.

8. At budget time, mandate that each agency provide statistics as determined by SOTF on sunshine responsiveness.

9. Require an assessment of sunshine compliance as a mandatory item for all Financial/Management audits.

10. Televise SOTF and Ethics Commission formal hearings.

11. Require active Ethics investigative files to be open.

12. Embrace fully the much-improved but incomplete example of posting online all interactions as part of large contract negotiations – as was partially done with TechConnect.

13. Host accounts payable/receivables online with the scanned images of invoices paid.

Rally Against Pink Slips

Hundreds of people– teachers, administrators, school staff, parents, children, union members, state and city officials– gathered in front of the State Building at McAllister and Van Ness, to demand job security for educators and to put education at the top of California’s priority list.
Governor Schwarzenegger’s 2008-09 budget proposes a $4.8 billion cut in state education funds. This would create a $40 million deficit for the San Francisco Unified School District and, in anticipation, the City’s Board of Education sent out 535 pink slips to administrators and certified teachers this week. Paraprofessionals and support staff wait in limbo to learn how many of their positions are on the chopping block.
Organization and activism were in full effect at the rally: participants wore pink clothes, and carried pink balloons and signs to flaunt their opposition to termination notices; letters were written to Schwarzenegger; people carried signs reading ‘Sell a Hummer, Fund a School’ and ‘Terminate the Terminator’; chants of ‘Books Not Bombs!’ rang out; car horns blared in support.
Superintendent Carlos Garcia, who was in Sacramento yesterday with 100 state superintendents and 60 City principals to speak out against the cuts, displayed an oversized pink slip addressed to Arnold, and incited the crowd with the statement, “The fight is just starting…let’s keep the fight going!”
A number of local politicians offered words of outrage towards Schwarzenegger, as well as support of educators. Mayor Gavin Newson stated, “It goes without saying that we are opposed to the governor’s cuts.” He added that the city is not going to sit back and wait for the state to solve its woes, noting “There’s a $40 million problem, but we have a $30 million solution in our back pocket.” This refers to the City’s current $122 million rainy day fund that would divert 25% one-time infusion to SFUSD during a crisis.
State Assembly members Mark Leno and Fiona Ma also spoke. Both made specific mention of a bill, to be introduced tomorrow by Democrats in Sacramento, proposing a 6% severance tax on oil production in the state, as well as well as a 2% windfall profits tax on oil companies that could create $1.2 billion in funds to mitigate budget cuts. State Senator Carole Midgen vowed “We will never let them cut our schools”, and Supervisor Ross Mirkarimi called this endeavor a “Fight against the lack of common sense” of the Governor.
The stars of the day were the teachers, and one who received a pink slip is Tara Ramos. She is a second year probationary teacher of Spanish in 4th and 5th grades at Paul Revere Elementary in Bernal Heights. Revere is one of eight Dream Schools in SFUSD, which face especially rigorous standards in the No Child Left Behind era because a majority of students are at-risk, non-native speakers, and low proficiency.
Ramos said, “100% of the staff told the principal they want to come back,” in a recent staff meeting, yet 21 of 30 certified teachers got served notices this week, and many paraprofessionals have job insecurity.
While explaining the ‘Program Improvement’ requirements of NCLB–where standardized test scores are analyzed by factors such as race–Ramos stated, “Look at our population of kids at Paul Revere…the number of white kids you can count on one hand.” The irony of the whole situation is not lost on her or her colleagues: the tough schools that are full of young teachers face the most uncertainty; layoffs and rehirings create a cyle of shortages and voids; teachers are under constant scrutiny to raise test scores, and now have to worry about their jobs.
“It’s not fair,” Ramos said adamantly. Yet, her priority remains the children. “I’m not so worried about my job. I’m here for the kids…I can get another job.”
As Superintendent Garcia stated, the fight is just starting, so pay attention to this important issue. Write, call, or email the Governor’s office if you are opposed to his cuts, and hold all the officials accountable to their promises of support and finances. This is a social justice issue at its core.

Health care paradoxes

OPINION What does homicide in the Western Addition have to do with the closure of the worker’s compensation clinic at San Francisco General Hospital? How does a mobile methadone-treatment van affect the broader public health of San Francisco?

These are just two of the questions that University of San Francisco nursing students are asking while San Francisco residents face a public health and safety crisis.

Public health and safety are both affected by economic conditions. Nonetheless, we must all question a need-blind cutback in services to public health.

It’s the task of San Francisco nursing professors to address the following confounding paradoxes:

Homelessness Nursing students, Department of Public Health staff, and a host of individuals and organizations work together at the commendable, but intermittent, Project Homeless Connect, while midyear budget cuts will shutter Buster’s Place, the only 24-hour drop-in center that serves homeless persons every day of the year.

Mental health Last semester USF students learned that increasingly scarce hospital beds for mentally ill and impoverished San Francisco residents were going to be cut back even further. Now budget cuts are planned that will decrease services for individuals on an outpatient basis.

Violence Nursing students learn about the effectiveness of education and physical exercise in ameliorating the deplorable conditions of the city’s housing projects and streets. The Western Addition has recently suffered from a spate of shootings; it seems an odd time to close a healthy and safe alternative to the violent streets such as tennis courts.

Occupational health The Occupational Health Clinic at SF General will soon be closed. USF students want to know why they should choose to work for a public health system that puts them at high risk for hepatitis B, HIV, back injury, and exposure to violent patients.

Substance use Methadone treatment for opiate addiction is an imperfect clinical intervention, but it’s certainly better than users overdosing on the street or spreading HIV and antibiotic-resistant skin infections by sharing needles. However, methadone treatment is expensive, and an innovative program to bring it to addicts will be delayed for budget reasons.

Access to care While the city’s health plan, Healthy San Francisco, is a laudable attempt to provide optional health care coverage to more residents, the budgets of public health clinics and hospitals that provide the care are being cut back.

Public health nursing San Francisco has pioneered effective programs tackling the disproportionate infant-mortality, asthma, diabetes, and hypertension rates among African American and Latino San Francisco residents. Now the cadre of public health nurses who do this work will be reduced, and Laguna Honda Hospital is being rebuilt with fewer patient beds. Who will monitor and support the disabled and seniors in the community if not the public health nurses?

As public health nurses, we implore our elected officials to protect the most vulnerable while making difficult decisions.

I guess there’s something to be said for term limits. State Senate President Don Perata, who will be out of office next year, said loud and clear yesterday something that’s needed to be said for a long time in this state: The governor’s budget cuts are unacceptable. And the state needs to find some new revenue.

The L.A. Times reports on a Perata press conference:

Perata drew his line in the sand while standing with his successor as Senate chief, Democrat Darrell Steinberg of Sacramento, and other Democratic senators and school leaders. Perata said the governor’s proposal to cut school spending by 10% is unacceptable, and Democrats will reject any budget that includes less for education next year than this year.

Asked how Democrats propose to make up the difference, Perata said: “Raise taxes. That clear enough? Raise taxes.”

Given the state’s dire finances, he said, “no one is going to tell me . . . the average Californian would not be willing to pay pennies on the dollar more for an education system . . . that is worth what we believe California is about.”

David Dayen at Calitics has the right line on this:

The second statement is exactly the way to play this. California is worth paying for. This state deserves a better education system than it’s getting, a better health care system than it’s getting, better infrastructure than it’s getting. Because of the broken revenue model, we can’t even fund the landmark global warming law that got the Governor on the cover of all those magazines. Paying for this state to have the society everyone generally wants is a patriotic act. That’s exactly the frame the Democrats are using.

There’s a hint of a “go-for-broke” strategy here, which I believe is sped up by the transition in the leadership. We’ve needed to have this fight for 20 years.

And so, the fight begins.

Grindhouse Psychos!

CULT DVDS Nepotism is hardly absent from mainstream Hollywood. But off-grid exploitation and sexploitation flicks have oft been a family affair by low-budget necessity. Russ and Eve Meyer, Ray Dennis Steckler and Carolyn Brandt, and Ron and June Ormond are only the most stellar names amongst many who purveyed legendary cinematic trash from the sanctimony of holy matrimony.

By coincidence, two of three features in Shriek Show’s not-too-shabby new discount box set Grindhouse Psychos! illuminate comparatively obscure marital exploitation couples. Cop Killers is a 1972 hippie drug-deal meller featuring actors who’d later go on to produce and star in the classic softcore spoof Flesh Gordon (1974). It’s not bad, though nowhere as good as the packaging ("In front of them, cops. Behind them, dead cops!"). Making a punchier impression are early-’80s titles that kept it all in the family.

Actually, Roberta Findlay’s 1985 Tenement, a.k.a. Game of Survival, a.k.a. Slaughter in the South Bronx, was released several years after husband Michael died in a bizarre helicopter-decapitation accident. Together they’d done it all: a kidnapping-rape film with pre-fame Yoko Ono (1965’s Satan’s Bed); an infamous trilogy of ultrasleazy late-’60s "roughies" (1968’s The Curse of Her Flesh, etc.); the 1974 cannibalism-meets-Bigfoot schlock masterpiece Shriek of the Mutilated; porn films both gay (Michael, Angelo, and David) and straight (Funk in 3-D). They engineered 1976’s Snuff, which capitalized on urban legend by intercutting crude new fake-documentary "murder" footage into a 1971 Findlay film shot in Argentina called The Slaughter. That con made millions.

Widowed Roberta soldiered on variably as director, cinematographer, producer, and scenarist for another decade, often under masculine aliases. Her activities ran a short gamut from porn (Lifestyles of the Blonde and Dirty) to horror (1987’s Blood Sisters). Tenement was an exception — an urban thriller à la Death Wish 3 (1985), Class of 1984 (1982), or any other ’80s movie where the evil gang was mixed race, punk, and dedicated to exterminating decent society. Here, one such crew gets arrested for shooting up in a Bronx apartment building’s empty basement. Freed five seconds later, they exact revenge by trapping and killing residents one floor at a time. Natch, the tenants fight back.

Considered so violent in 1985 that it was given an X rating, Tenement survives as the kind of vigorously crass grade-Z exercise that gives vintage exploitation a good name. Findlay is bemused and delightful in her DVD-extra interview, recalling the shoot amongst real junkies and gangs like a retired teacher might remember naughty third graders.

Much less prolific than the Findlays were Joseph Ellison and Ellen Hammill-Ellison, creators of just two New Joisey B flicks. Their incongruous 1986 doo-wop musical, Joey, bombed. But six years earlier, Don’t Go in the House made the full drive-in and grindhouse rounds, achieving disreputable immortality as an oft-cited example of extreme horror misogyny. Emotionally scarred by a late mother who’d used the gas stovetop as a disciplinary tool, Norman Bates–like nebbish Donny (Dan Grimaldi, The Sopranos‘s Patsy Parisi) lures women to his creepy hilltop home, where he gets back at mommy by burning them to death.

The reason this movie became notorious is the first such death. It left a lingering icky stain on my brain — among many others — and is mighty disturbing still. Gentleman Donny offers a ride to a stranded flower-shop proprietress (Johanna Brushay), who’s given enough screen time to seem like a real person rather than slasher-flick cannon fodder. Knocked unconscious after an unsettling buildup, she wakes to find herself naked, suspended from ceiling to floor in a metal-walled room he’s assembled for his new pastime. Entering in a flame-retardant suit, he douses her with gasoline, then applies a blowtorch at length — the grisly result patently faked by FX superimposition but horrible nonetheless.

Nothing else in this flaming Psycho imitation is so vividly appalling. But that sequence alone places House firmly in the special category of overenthusiastically female-abusive films one can’t quite believe a woman actually helped produce, let alone cowrote.

War on science

TECHSPLOITATION Over the past eight years, the lives of millions of people in the United States and beyond have been endangered by the US government. No, I’m not talking about the war in Iraq. I’m talking about the quiet, systematic war the government has been waging against science.

You may have heard about gross examples of the government censoring scientific documents. For example, it was widely reported last year that a government regulatory group excised at least half the statements Centers for Disease Control director Julie Gerberding was set to make at a congressional hearing about how climate change will affect public health. You may also have heard about the scandal in 2004 when a whistleblower at the Environmental Protection Agency revealed that five of the seven members on a panel of "independent experts" stood to gain financially from shutting down a scientific investigation of a controversial mining technique called "hydraulic fracturing." The panel claimed that in its expert opinion, the technique didn’t require regulation, despite many scientists’ concerns that it might pollute groundwater.

But these are the stories that hit the headlines. There are hundreds more where they came from, and many of them are documented meticulously in a study released earlier this month by the Union of Concerned Scientists (UCS) called "Federal Science and the Public Good." The UCS report documents, in chilling detail, how agencies have fired scientists who disagreed with government policies. For example, in 2003, experts in nuclear physics were dismissed from a panel within the National Nuclear Security Administration because some of them had published about how the George W. Bush administration’s beloved "bunker buster" weapons weren’t very effective. And scientists who spoke out against the administration’s stem cell policy were booted from the President’s Council on Bioethics.

Worse, the government has falsified scientific studies to bolster its policies and undergird its ideological positions. Perhaps the most egregious example of this was when the EPA lied outright to Americans that the air around ground zero directly after Sept. 11 was safe to breathe. In fact, according to the UCS report, the EPA made this statement without even testing the air. As a result, the authors of the report write, "thousands of rescue workers now plagued by crippling lung ailments continue to feel the impact of this public deception." There’s also an example of the Food and Drug Administration inventing a fake study to support its decision to approve the drug Ketek, along with many others.

Most intriguing, though, is the UCS report’s suggestion that many federal regulatory agencies may in fact be breaking the law by cutting real science out of government policy decisions. Both the Clean Air Act and the Endangered Species Act require the EPA and the US Fish and Wildlife Service to base their decisions on "the best scientific data available." And yet the UCS has documented countless examples of both agencies, as well as others, refusing to take into account the latest research on climate change, animal populations, and systems biology.

It would be intriguing to see a lawsuit based on the fact that these agencies aren’t using "the best scientific data available," but the UCS doesn’t suggest that as a remedy. Instead, the report concludes by looking to the future of federally funded science, suggesting ways the next presidential administration might remedy the failures of the last.

First on the agenda would be to bring a scientific adviser back into the cabinet. (Bush dismissed this adviser from the cabinet.) The UCS also suggests that the next president repeal Executive Order 13422, which gave an obscure regulatory body known as the Office of Management and Budget a lot of control over how regulatory agencies handle science. Currently the OMB has the power to revise the findings of scientists within those agencies, despite the fact that the OMB has little to no scientific expertise. And finally, the UCS asks that the government extend protections to whistleblowers within the government who come forward to report on the very kinds of abuses the UCS has reported (often with the help of whistleblowers who lost their jobs or worse).

Hopefully the next presidential administration will relegate this report to the status of historical document instead of a warning about our future. Science is crucial to the management of the nation, and without it we’re no better than a medieval kingdom.

What do army barracks, prisons, hospitals, and dog pounds have in common? They all have minimum and legally enforceable standards of care, something absent in San Francisco’s homeless shelters. Legislation to fix that problem now appears to be shaping up as the latest political skirmish pitting fiscally conservative Mayor Gavin Newsom against progressives on the Board of Supervisors.

The Board of Supervisors’ Budget and Finance Committee met Feb. 20 to hear testimony and discuss proposed legislation that seeks to impose basic requirements on city-funded shelters, improve complaint procedures, and allow fines for noncompliance (see "Setting Standards," 1/30/07).

Prior to the hearing, dozens of activists, city officials, and homeless people rallied on the steps of City Hall in support of the legislation, holding colorfully painted signs with references to some of the proposed requirements, including "nutritious meals," "clean sheets," and "8-hour-a-day sleep."

Marlon Mendieta, program director at the Dolores Street shelter, took to the podium to make his case for supporting the legislation: "It may seem strange that a service provider would be here to support legislation that will cost money and more time and more work — it’s easy though. It’s an issue of human rights."

The scene was just as lively inside as demonstrators and officials packed the board’s chambers. The committee — composed of Sups. Aaron Peskin, Bevan Dufty, and Tom Ammiano (sponsor of the ordinance) — took testimony, almost all of it urging the committee to pass the legislation on to the full Board of Supervisors for approval.

Dariush Kayhan, who has been on the job for six weeks as the mayor’s appointed homeless policy director, gave the only testimony urging the committee not to pass the legislation.

"This is the part where we have some concerns, the fiscal part," Kayhan said. "Give us more time, maybe we can plow some of these items — the ones we can agree on — into the existing contracts," he said, referring to the contracts awarded to nonprofit organizations who manage the city’s shelters.

While the city’s contracts with shelter providers do spell out many standards, a recent Guardian investigation (see "Shelter Shuffle," 2/12/08) and work by the Shelter Monitoring Committee, which developed the recommendations embodied in Ammiano’s legislation, found they are often ignored with no consequences. The Guardian also found that people are being turned away from the shelters every night despite vacancies.

Mayor Gavin Newsom, in a letter to supervisors obtained by the Guardian, voiced his concern with the fiscal impact of the legislation, citing a $2.4 million price tag, the high end of costs developed by the Budget Analyst’s Office, which said the legislation could cost $1.7 million or even less. Advocates of the legislation are confident they can bring its price down.

The $2.4 million estimate assumes a new security guard will be hired at each shelter to meet safety requirements. The legislation does not specifically mandate new personnel and many argue increased staff training and facility improvements could provide cheaper alternatives.

The Shelter Monitoring Committee, composed of mayoral and board appointees, estimates the cost will be closer to $1 million, which amounts to less than half of 1 percent of the city’s total projected deficit of $225 million.

"This is an investment in a population that has not been invested in in a long time," committee chair Quintin Mecke said at the hearing. "I don’t think there is any reason to wait to make sure people have access to toilet paper, have access to clean conditions, have access to ADA [Americans with Disabilities Act] -compatible beds."

At Ammiano’s request, the committee decided to postpone the vote for two more weeks to try to work out differences with the Mayor’s Office, and set the next hearing for March 5. If the supervisors proceed without Newsom’s support and he ends up vetoing the legislation, it would take the vote of eight supervisors to override and implement the standards anyway.

Newsom and the board have been at odds over homelessness and other budget priorities. Buster’s Place, the city’s only 24-hour drop-in shelter, is now caught in the middle of the political tug-of-war between budget cuts and shelter improvements. There is a provision within the standards of care legislation that mandates a 24-hour emergency drop-in center. At the time it was drafted, Buster’s Place filled this requirement.

However, due to the timing of the midyear budget cuts ordered by Newsom, the Department of Public Health cut off funding for Buster’s, effectively closing the center at the end of March (see "No Shelter from the Budget Storm," 2/20/08). It is now unclear how the requirement will be met if the legislation passes.

"We’re tired of having centers like Buster’s Place on the chopping block," Mecke told the Guardian. "It’s ludicrous to keep going in this cycle over and over again." Buster’s was slated to close six months ago but was rescued by a Board of Supervisors’ budget add-back, and a year before that, McMillan’s (another 24-hour center) was forced shut its doors.

The ordinance seems to challenge Newsom’s recent efforts to whittle back shelter services. It would allocate more funds to a department Newsom is trying to cut and assure the existence of an emergency 24-hour center, a clear departure from Newsom’s recent announcement that he wants to ultimately "get San Francisco out of the shelter business."

The most controversial requirement within the standards of care legislation seems to be its enforcement mechanism, calling for fines of $2,500 levied against the nonprofit service providers for noncompliance. While Kayhan voiced reservations about creating new staff positions to carry out enforcement, the SMC has insisted the fines are crucial and will only be used as a last resort.

"In 2004, the supervisors [created the] Shelter Monitoring Committee because contract compliance was not working," Mecke said. "If there are policies in theory, they should be legalized and should become mandates and be enforced."

Barbra Wismer, the medical director of Tom Waddell’s clinic, which frequently serves homeless men and women, urged attendees at the budget meeting to put politics aside and remember the importance of shelter standards, not just for the current homeless population, but for all San Francisco residents.

"If there was a natural disaster like an earthquake, or a fiscal disaster like increased foreclosures, and 1 to 2 percent of people — 14,000 in San Francisco — had to be put in emergency shelters," Wismer said, "we do not have any standards to protect them."
