Bling in the police union’s new contract

Some might suggest that reading reports from the city’s budget analyst over tumblers of well bourbon at Mission Bar is a little pathetic. They’re right, but the damn things are so often full of such great little stories, we can’t help it. And they’re not available on the city’s Web site; you have to request and obtain them from the board clerk’s office, leading us to wonder how many people actually read them.

San Francisco’s longtime Budget Analyst Harvey Rose reviewed more than two-dozen union contracts for city workers passed this year by the Board of Supervisors. You’re gonna love what we found in the police union’s new agreement with the city.

San Francisco police officers don’t like living inside city limits, because they say it’s too expensive. Cops do fairly well here, and as we reported awhile back, Gary Delagnes, president of the San Francisco Police Officers Association, even anticipates that his union’s rank-and-file will be the highest paid in the nation by 2011.

But that’s not enough to keep officers from escaping to the ‘burbs, which would pose a serious logistical problem if a major natural disaster occurred and emergency personnel couldn’t cross damaged bridges back into the city fast enough. Sup. Ross Mirkarimi contended earlier this month that 75 percent of the force lives outside the city, and he wants more recruitment efforts to take place within the heart of San Francisco. An equally startling number of firefighters live elsewhere, too.

So the city of San Francisco will be handing $20,000 checks to officers as a down payment on a home in the city if they move back. It’s actually a “loan,” but it doesn’t have to be paid back if the recipient lives in the home for at least five years. If the cop is a renter, they can receive $5,000 for “relocation-related expenses.”

A vote on public broadband

EDITORIAL It’s annoying that San Francisco progressives and good-government voters will have to spend time and money this fall trying to defeat Mayor Gavin Newsom’s phony wi-fi initiative. It won’t be easy, either: the mayor is, in the words of one blogger, Sasha Magee, promising free ice cream. He’s telling San Franciscans that they can have wireless Internet access everywhere in town without paying a dime. Hard to get people to turn down that deal.

But the mayor isn’t telling the truth — and when this battle is over, the progressives need to offer a much better alternative.

For many people, the promise of Internet access in the mayor’s plan will prove to be entirely false. The wi-fi deal that Newsom has put together will probably work fine for people checking their e-mail on laptops from park benches downtown and outdoor tables at sidewalk cafés. But people who live or work deep inside buildings, far from windows and walls, won’t get any signal at all. And anyone who lives or works more than two stories up won’t get a signal either.

And of course, the free signal, when it works, won’t be fast enough to do much but (slowly) check your e-mail, if there are no attachments to download. You want real broadband, you’re going to have to pay a monthly fee.

That, as we have reported over and over, is because this is a private-sector deal: the network (if it’s actually built) will be owned by EarthLink and Google, and the two companies will be trying to make money off it. They’ll do that by selling premium service (that is, service at a rate most people would consider tolerable) and by targeting everyone on the network with ads.

Although the ballot measure is vague and legally meaningless, it will be the vote of confidence Newsom can use to push the Board of Supervisors to approve his EarthLink-Google deal — that is, unless, as has been widely suggested in the business media, EarthLink shifts direction and decides not to pursue any more municipal wi-fi deals and the city is left holding the bag. So advocates of a true universal broadband alternative need to start working now to present another, better option.

And the best way to do that is to begin drafting a comprehensive citywide broadband initiative for the June 2008 ballot.

Broadband access is and ought to be part of the city’s basic civil infrastructure — something that, like water (and, someday, electricity), is offered through a publicly owned and controlled system at the lowest possible rates. Low-cost broadband would be an immense advantage to local businesses and a huge convenience for local residents and (unlike Newsom’s joke of a deal) would actually do something to address the digital divide.

Wi-fi would be a part of the package, of course, but the plan should also include a citywide fiber-optic network that would bring reliable, fast, and technologically up-to-date Internet access to every address in the city. And while it would cost the city some money up front to build it, the system would almost certainly pay for itself in just a few years. And it could be paired with the construction of a citywide public power system.

Next June may not be a high-turnout election statewide, but in San Francisco, Democrats will be out in force with one of the most contested primaries in local history, pitting Assemblymember Mark Leno against Sen. Carole Migden for the Third District senate seat. Both candidates will be pushing voter turnout — and both can be pressured to support publicly owned municipal wi-fi as a campaign issue (and to back the growing antiprivatization agenda in San Francisco).

Defeating the mayor’s plan is just step one — and the time to start with step two is today.<\!s>*

Redevelopment’s new face

City Hall’s cavernous marble corridors echoed Aug. 14 with the footsteps of a band of sharply dressed African Americans, many of them ministers and all of them come to voice support for Fred Blackwell’s appointment as executive director of the San Francisco Redevelopment Agency.

Blackwell, who has a master’s degree in city planning from UC Berkeley and has been working for the Mayor’s Office of Community Development since 2005, most recently as director, won’t be the first African American to occupy the agency’s top post.

But Mayor Gavin Newsom’s decision to nominate Blackwell was seen by many as a hopeful sign that the agency might proactively address problems that have torn apart the Bayview–<\d>Hunters Point community in the past year and continue to dog the agency in the Western Addition.

These concerns include the suspicion that Newsom’s plan to fold Candlestick Point into the already controversial Hunters Point Shipyard redevelopment project is less about wooing the 49ers to stay and more about jumping into bed with Lennar Corp., a deep-pocketed and politically connected development company (see "The Corporation That Ate San Francisco," 3/14/07).

The deal gives Lennar the right to develop 6,500 new housing units and take over the cleanup of Hunters Point Shipyard — a move mayoral candidate Dr. Ahimsa Porter Sumchai described as "the dirty transfer of the shipyard" (see "And They’re Off," 8/15/07).

A growing body of Bayview–<\d>Hunters Point residents has asked the city to temporarily shut down construction at the shipyard’s Parcel A because of concerns about the toxic dust being kicked up (see "Dust Devils," 8/1/07).

And then there’s lingering ill will from the 1960s, when redevelopment caused the massive displacement of African Americans from the Western Addition.

So will Blackwell be able to solve the agency’s deep-rooted problems? Newsom described Blackwell as "an outstanding choice" when nominating him Aug. 10, while agency commission president Rich Peterson called Blackwell "smart, of high integrity, well known by community leaders, and familiar with the unique opportunities as well as important lessons learned of redevelopment in the city."

But while commissioner Francee Covington declared that "a new day is dawning at the agency" shortly before the commission voted 7–<\d>0 to appoint Blackwell, the African American community still has its concerns.

Minister Christopher Muhammad, who has led the voicing of concerns about the Parcel A dust, was proud to see an African American in a position of leadership. "But we are still going to hold your feet to the fire," he said. "Redevelopment is not just about the redevelopment of physical structures but [also] about the redevelopment of human beings."

Noting that Blackwell is a 1991 graduate of Morehouse College, Rev. Amos Brown said, "I find no fault in this man, and you will not find any either in terms of fitness for this office," while local resident Randall Evans voiced his belief that "the only folks gonna take care of black people’s business are black folks."

Activist-journalist Ace Washington observed that Blackwell is "coming into a very hot seat. He needs some ice cubes to sit down. Only time will tell if he stands by his convictions. It doesn’t matter if the director is black, Latino, Asian, or white. All of us here are saying, ‘Ah, a breath of fresh air.’<\!s>"

Rev. Arnold Townsend said, "We trust the resources are there to help community — and not to tell the community what to do. Because until that dynamic changes, it won’t matter who is executive director."

Blackwell conceded that he had misgivings about heading an agency founded in 1948 to remove blight, a mission that many say has been tainted by racism since its inception. "I admit I was not leaping and jumping when my name first surfaced, but I look forward to working with you all," Blackwell told the commission.

Blackwell later told the Guardian he hopes "to foster a sense of equity and opportunity and a broader vision of community development."

"The legacy of redevelopment and urban renewal is not a good one," he said. "The residue is still there, but trust is only built through action."

Describing the Western Addition and Bayview–<\d>Hunters Point as "two bookends in terms of redevelopment," Blackwell said he hopes "to close out the agency’s relationship with the Western Addition and make sure responsibility is transferred seamlessly to the appropriate agencies."

As for Bayview–<\d>Hunters Point, "we should take stock of what we should and should not do, get on the right track, and create opportunities for people who live there," he said.

But Sumchai wants to put the agency under the control of the Board of Supervisors: "You could appoint Jesus of Nazareth and still have problems as long as the agency is locked into its current structure."

Sup. Ross Mirkarimi says putting an African American at the head of the Redevelopment Agency "makes a lot of sense, considering the egregious and negative impact the agency has had on the African American community…. But no matter how well-liked Fred Blackwell is, that does not compensate for the deficiencies of the Redevelopment Agency’s aims and competence."<\!s>*

Oppose Don Fisher’s museum

EDITORIAL Not long after the US Army announced it no longer needed the Presidio for a military base, a group of powerful San Francisco business leaders began eyeing what would become the first privatized national park in America. Among the businesses aiming to grab a piece of the immensely valuable real estate were Pacific Gas and Electric Co. and Transamerica Corp.; among the individuals was the founder of the Gap, a Republican named Don Fisher.

Fisher helped then–US representative Nancy Pelosi pull off an astonishing feat: she took more than 1,200 acres of land earmarked by federal law as a national park and handed it over to real estate developers (see "Stolen Base," 5/8/96). Fisher, who became one of the first members of the private board that manages the Presidio, was around to help George Lucas build a massive business park on the site — and pick up a $60 million tax break in the process.

Now Fisher, who along with his billions has amassed a pretty impressive collection of contemporary art, wants to build a gigantic private museum right in the heart of the park, at the site of the old post. His plan would drop a 100,000-square-foot Battlestar Galactica on the old parade grounds, wiping out a sizable amount of open space. The museum would be on public land, but he’d run it himself, in his own way, with no public oversight.

This is a terrible idea, and San Franciscans ought to be up in arms about it.

According to reports in the San Francisco Chronicle, Fisher has been looking for some time for a way to display his art collection, and he has talked to people at the existing big museums, the Museum of Modern Art and the de Young. But those talks broke down — in part, we’re told by sources, because Fisher didn’t want the professional curators and museum directors calling any shots. He wanted complete control over the art — control over where it was hung, when it was displayed, who got to see it, etc. The folks who run those cultural institutions are too polite to say so in public, but they don’t generally go for that sort of demand. So Fisher did what billionaires around the country are starting to do: he decided to build his own museum.

That’s his right, of course, and if he’d sought a spot, say, South of Market near SFMOMA, it might not be a bad thing. But the Presidio is entirely the wrong place for this sort of institution.

For starters, there’s no easy way to get there. Transit to the main post at the Presidio is very limited — one Muni line, which runs infrequently. No BART, no light rail — nothing of the sort of access you would want for a major public attraction. Car access is through the crowded Marina neighborhood, and the museum would no doubt build a huge parking garage, meaning the park and the surrounding areas would be inundated with cars. That alone would be a violation of the spirit of all the nation’s parks, which are trying desperately to reduce the number of car visits. There are no other cultural attractions around, so visitor traffic to Fisher’s museum would have no spillover benefits for any other museums.

And he’s talking about a whopper of a structure. There’s no way to gently insert a building that big into the park; it can’t blend in with the existing structures or the natural scenery. It’s just going to stick out like a bloated, gangrenous sore thumb, ruining the view and the historical nature of the area.

The private Presidio Trust has sole discretion over the proposal, but city officials can speak up, loudly. The Board of Supervisors should pass a resolution opposing the museum, the arts community should demand that it be relocated, and the public at large ought to tell the trust and Fisher that his personal memorial edifice isn’t welcome in the park.*

Some interesting mail landed in the boxes of Potrero Hill residents last week: flyers with a photograph of industrial stacks spewing plumes of pollution. They read, "Potrero Hill doesn’t need three more power plants in our neighborhood."

There’s a handy clip-out membership card to join the Close It! Coalition, from which you can "find out more about the city’s rush to judgment and their plan to put more power plants in our neighborhood." The return address on the card is 77 Beale, which isn’t in "our" neighborhood at all.

It’s the address of the downtown headquarters of Pacific Gas and Electric Co.

The utility, in the guise of a grassroots community organization, is opposing the contract that the San Francisco Public Utilities Commission is currently hammering out with a private company, J-Power USA, to build a new 145-megawatt, natural gas–<\d>fired power plant on a four-acre plot at 25th and Maryland streets. The plant would be owned and operated by J-Power for a period of 10 to 12 years, after which the title would turn over to the city.

This so-called peaker plant, one of three that would run when San Francisco’s power needs exceed the normal load, would be cleaner burning than Mirant’s dirty old Potrero Hill power plant, which city officials and environmentalists want closed. Mirant’s "Reliability Must Run" contract with the California Independent System Operator (Cal-ISO) could be terminated once the three peakers (whose generators the city received years ago through a lawsuit settlement) are built, according to the SFPUC.

Though PG&E, which has a questionable environmental record, claims to be against the peaker plants for pollution reasons, public power advocates say this is really opposition to the city owning its power sources. "PG&E has finally gone over the line. This is a good thing because this is so egregious and so transparent," said Joe Boss, a Dogpatch resident who received the mailer. "They’ll do all they can do to kill public power in San Francisco."

Boss and a group of neighborhood activists who support the construction of the peakers have put together their own mailer countering the claims of the Close It! Coalition, which has been dormant lately but was active prior to 2006, when community activists were fighting for the shuttering of PG&E’s Hunters Point power plant.

Other anti–<\d>public power literature also circulated recently in supervisorial district 11, where the California Urban Issues Project sent a flyer urging residents to oppose Community Choice Aggregation, the city’s gradual public power plan that is focused mostly on renewable energy sources. The mailer was apparently sent before the Board of Supervisors voted to approve the plan, which it did in June.

Sup. Ross Mirkarimi, who coauthored the CCA legislation with Sup. Tom Ammiano, called the CUIP flyer "shameful" and told the Guardian, "This is signature PG&E, but it’s not just PG&E. It now very well implicates the [Gavin] Newsom administration either with complicity or silence." The CUIP board includes Committee on Jobs director Nathan Nayman, small-business advocate and Newsom appointee Jordanna Thigpen, Democratic Party political consultant Rich Schlackman, Golden Gate Restaurant Association executive director Kevin Westlye, and other Newsom supporters.

Newsom signed the CCA legislation but tacked on a letter vaguely expressing concerns about the plan. He recently authored a letter to Cal-ISO expressing his support for the peaker project. While PG&E is opposing peakers here, it has plans under way to build at least two farther south, near communities it is also battling.

The San Joaquin Valley Power Authority has filed a formal complaint against PG&E with the California Public Utilities Commission regarding how the utility is conducting itself as the community moves forward with a plan for public power.

The SJVPA is a group of 11 cities and two counties, representing about 300,000 citizens, that has filed a plan with the CPUC to purchase its power through a CCA plan. Assembly Bill 117, written by Sen. Carole Migden when she was in the State Assembly and made law in 2004, allows communities to act as their own wholesale power customers and purchase electricity for residents.

San Francisco, Marin, Berkeley, Oakland, and Emeryville are working on CCA plans, but the SJVPA is the furthest along. With CCA, power is still transmitted by utility companies, but residents pay their electricity bills to the city. The SJVPA plans to build its own 500 MW power plant — which PG&E also opposes, claiming studies show it isn’t necessary — and has issued a request for proposals from interested companies for 400 MW of renewable energy. It estimates citizens would save about 5 percent with CCA.

But representatives of PG&E have been attending city council meetings in the area and even holding their own informational workshops at which they refute elements of the CCA plan.

In a lengthy memo sent to a Hanford City Council member and very similar in tone and content to one distributed to San Francisco nonprofit organizations a couple of months ago, PG&E offers misleading claims such as "Over 30 percent of PG&E’s supply comes from a diverse portfolio of renewable energy … about 20 percent comes from PG&E’s large hydro system, and approximately 12 percent comes from smaller renewable generation sources."

But according to state law, a large hydro system does not qualify as a renewable energy source — a rule the utility doesn’t apply to itself but is quick to point out a paragraph later when it attacks the CCA plan for renewable energy.

The SJVPA complaint details several examples of PG&E spokespeople cautioning against the plan in local media and at public meetings. CEO Peter Darbee even penned an editorial for the Fresno Bee in which he wrote, "The fundamental problem with the program is that the numbers don’t add up," a statement he attempted to clarify with unsourced data showing that rates will go up even if the CCA plan says they won’t. Darbee went on to say that PG&E is just looking out for the best interests of the people.

The Fresno City Council recently voted 4–<\d>3 not to join the SJVPA, a close vote that "was based in large part on PG&E raising questions," said David Orth, the general manager of the Kings River Conservation District, which is overseeing the implementation of the CCA plan. "That is their intent, frankly — to clutter the discussion and decision-making field with a lot of uncertainties and threats of complexity."

Fresno would have been the largest consumer of power in the coalition, using 45 percent of its electricity.

Orth said obfuscation has been the utility’s tool, coupled with reassurances that power "is too difficult for you to understand, so accept the status quo."

He said PG&E hasn’t been entirely factual with its advice and cited a specific example in which PG&E claimed that if a community opted out of CCA after joining, it could be liable for as much as $11 million. "It was a fabricated number, and it was a fabricated scenario, but it lead certain council members to believe there was a risk we weren’t explaining," Orth said.

Lawyers representing the SJVPA say the utility is using ratepayer funds for its anti-CCA marketing, and that’s a violation of the CPUC’s rules. AB 117 states clearly that utilities should cooperate fully with municipalities enacting CCA plans. In a December 2005 decision seeking to clarify how CCAs will be implemented, the CPUC wrote, "There is little if any benefit from permitting a battle for market share between CCAs and utilities. Of course, we expect utilities to answer questions about their own rates and services and the process by which utilities will cut-over customers to the CCA. However, if they provide [sic] affirmatively contact customers in efforts to retain them or otherwise engage in actively marketing services, they should conduct those activities at shareholder expense. We do not believe utility ratepayers should be forced to support such marketing."

"SJVPA is informed and believes and thereon alleges that these marketing and related activities were undertaken at PG&E’s ratepayer expense to compete against SJVPA," the authority’s lawyers wrote in the complaint to the CPUC.

Even if PG&E is drawing from the proper budget for the marketing, the appearance that it isn’t needs to be addressed, and the SJVPA complaint further calls on the CPUC to clarify its rules on what utilities can and can’t do. Local customer representatives, usually salaried by ratepayer funds, are telling folks to stick with PG&E, and that’s a betrayal of trust. "You have someone who’s worked with a customer for years and years and years saying, ‘Don’t support CCA,’<\!q>" Orth said.

PG&E, which has disputed the allegations in the SJVPA complaint, did not return our calls seeking comment. The two parties are currently in mediation, and SJVPA attorney Scott Blaising said the utility has yet to provide solid evidence that ratepayer money isn’t footing the bill for the anti-CCA marketing. Southern California Edison Co., which provides about a quarter of the SJVPA’s current power, has not been as contentious as PG&E, Orth said.

"Theoretically, [anti-CCA marketing] should be covered by shareholders," said Bill Marcus, an energy consultant who works with the Utility Reform Network. "Realistically, a bunch of it leaks into ratepayer accounts."

He pointed out that PG&E’s budget allocation for local public affairs has stood at 22 percent over the course of several general rate cases, despite clear peaks in marketing for certain campaigns.

Some San Franciscans will be closely watching what happens next as a sign of things to come as this city moves forward with its CCA plan. As Mirkarimi told us, "What San Joaquin is experiencing is likely a prelude to what San Francisco will be confronting as it pertains to PG&E’s desire to deny CCA and San Francisco’s pursuit of energy independence."

Migden, who wrote the CCA law, said, "PG&E’s alleged actions controvert the letter and the spirit of the bill. The utility and the SFPUC should take heed, because green public power is the people’s passion."<\!s>*

Daly will not run for mayor

Sup. Chris Daly, who was talking over the past few days about a campaign for mayor, has decided against it. He sent a statement tonight; I’ll post the whole thing:

Progressive Allies and Friends,

For the past 6.5 years, we have enjoyed strong
progressive politics in San Francisco. Progressive
San Francisco has delivered a new era of worker’s
rights with the nation’s highest minimum wage,
universal health coverage, and paid sick days.
Requiring significant amounts of affordable housing
and other public benefits, we’ve made development work
for communities. We’ve set the agenda on workers’
rights, housing, health care, city services,
transportation, and the environment. Our political
opponents, even holding the office of Mayor, have been
on the defensive.

Despite our political strength and its marquis
standing in local political races, it’s clear that
we’ve had difficulty engaging in this year’s Mayor’s
race. Progressives share a principled critique of the
personality-driven politics practiced by our
opponents. We elevate the issues important to
everyday people above our own political advancement
and personal self-interest. We are right to do so.
Unfortunately, this does not always translate well
into the mainstream and corporate-controlled media.

For the better part of a year, I felt a great deal of
responsibility to find a strong progressive candidate
for Mayor, all the while acknowledging that I was not
our best possible candidate. There were discussions,
caucuses, lunches, and even a Progressive Convention
aimed at compelling a progressive entry into the race.
With news last week of the final potential candidate
forgoing the race, I decided to take another look at
making a run.

This past week Progressive San Francisco produced a
flurry of activity about that possibility. I was
heartened and inspired that so many were willing to
step up in the face of significant odds. Dozens of
you dropped what you were doing to spend hours on end
with me this week. Hundreds pledged your support.
The outpouring gave me hope that we do have what it
takes to take back Room 200 and deliver social and
economic justice to San Francisco.

However, I have decided not to file a candidacy for
the Office of Mayor.

Given the negative, million-dollar campaign against me
last year, there was never a question that this
Mayor’s race would be brutal. The incumbent promised
as much in a meeting this week. Our ideas are better,
and I was committed to running a campaign about our
issues. But most of us had reservations about whether
we’d ever be able to achieve resonance on the issues
against the tide of hits, personal attacks, and media
hype of the Newsom vs. Daly personality clash.

Sarah and I arrived at last night’s meeting with the
intention of announcing my entry into the race and
were moved by everyone’s willingness to act on faith.
When I called on progressives for support for a
Mayoral run, progressives responded. But I also
sensed that the reservations in the room were real.
Progressives are certainly ready to vie for the
Mayor’s seat, but, unfortunately, I am not the right
candidate.

There is some good news. Progressives are much
stronger than we were the last time we didn’t field a
challenger for Mayor. Back in ’83, the progressive
movement had not recovered from the Milk/Moscone
assassinations and the subsequent repeal of district
elections. Dianne Feinstein enjoyed great popularity
after soundly squashing a recall effort. She went on
to easily win reelection later that year.

Four years later it appeared as if downtown’s reign
would continue with the front-running candidacy of
John Molinari. His bid, however, was upset when Art
Agnos united San Francisco’s left with a disciplined,
sustained, and effective campaign.

We all know that electoral work is just a part of the
overall effort we need to put forth. There is no
substitute for the basics of organizing and serving
our people so they can live with dignity. I will
always remain committed to the struggle and to
building progressive politics and people power in San
Francisco for the years to come.

Peaker plants and SF’s energy future

EDITORIAL Over the next few weeks, the Board of Supervisors will be looking at two major electric-power programs that could add a lot of new generation capacity (and possibly new pollution) to southeast San Francisco and a new source of backup power from out of town. Both projects seem to have broad support at City Hall.

The main questions that city officials ought to be asking about plans for a new power plant in Potrero Hill and a new power cable to bring electricity across the bay are:

Do we really need either?

What is motivating the powerful but little-known state agency to demand that San Francisco — the only US city with a federal public power mandate — prepare for a future in which energy use continues to grow, conservation lags, the private sector controls the city’s power supply, and the city’s plans for cutting power use are a failure?

The California Independent System Operator, known as Cal-ISO, was created in the wake of the wretched energy deregulation plan that the State Legislature concocted in 1996. The outfit, run by a five-member board appointed by the governor, is supposed to ensure that every part of California has enough electricity — now and in the future.

But the board members are almost all former utility executives, including a retired Pacific Gas and Electric Co. official, and like most utility executives, they seem to believe that the only track for electricity use is upward.

So Cal-ISO has informed San Francisco that it doesn’t have enough power on hand to make it through 2010. That means the city needs to either find a new way to import more power (the only significant current pathway is a cable that runs up the Peninsula and is owned by PG&E) or build more power plants inside its limits.

The problem with building more plants, particularly the kind of plants Cal-ISO likes — fossil fuel burners that can run day and night without interruption — is that San Francisco residents are trying to get rid of the last big polluting plant, Mirant Corp.’s facility at the foot of Potrero Hill, not build more.

So the latest solution involves the installation of three natural gas–<\d>fired generators known as peakers, which would run only when demand is high and other sources (including the solar facility the city plans to build) aren’t operating. The mayor and the supervisors are referring to these plants as "city-owned generation," making this sound like a big step on the way to public power.

And on one level, it is: San Francisco won the turbines (which are essentially big jet engines) as part of a settlement with Williams Energy after the energy crisis, and they could be part of a municipal utility. But the current plans call for the Chicago subsidiary of a Tokyo company, J Power, to build the structures that would house the turbines and hook them up to the power lines, then operate the plants for 10 years. Only then would they revert to city ownership.

So already San Francisco is waffling on the public power issue. (Why, for example, can’t the city build the facilities itself and hire its own engineers to hook up the turbines and run them? Why do we even need a private, outside partner?)

Then there’s the environmental impact. In theory, if the peakers only ran a few hours a day, they would spew less junk into the air than the Mirant plant currently does. And Cal-ISO is only willing to allow the Mirant plant to shut down if San Francisco develops some other form of firm local generation. But there’s nothing in writing anywhere to guarantee that the foul exhaust from Mirant would cease when the peakers fired up; in fact, it’s possible that the southeast part of the city could wind up living with both.

The other project, called the Trans Bay Cable, would be a privately owned venture carrying power from Pittsburg across the bay and into San Francisco. The power plants that would feed the cable are largely nonrenewables, and although they’re outside town, this is hardly an environmental advance.

The big question, though, is why San Francisco has to go through this exercise.

Cal-ISO predicts that the city will run short of power in a few years — but that forecast is awfully suspect. For starters, the entire projected shortfall is five megawatts in 2010, growing by 10 MW per year after that. And the city’s projections for Community Choice Aggregation suggest that conservation measures can cheaply reduce demand, by 107 MW, over the same period. Conservation, also known as demand-side management, is by far the least expensive and most environmentally sound alternative.

In fact, with an aggressive conservation plan and an aggressive solar program, it’s possible that the city could handle the local load just fine without the Mirant plant or the peakers.

That, of course, would leave much of the power in the hands of PG&E — and make the city too heavily reliant on the one Peninsula cable. That’s what makes the giant extension cord from Pittsburg seem so appealing. But the city has also been talking about extending its power line from Hetch Hetchy, which now ends in Newark, across the bay — and that city-owned, city-run alternative would make far more sense. (The company that would own the Trans Bay Cable, Babcock and Brown, has offered San Francisco a handful of cash, a total of $75 million over 25 years, to make the deal sound sweeter. But that’s birdseed compared with the revenue the city would get by building its own line and moving to create a full public power system.)

Infrastructure decisions like these tie the city down for many years to come, and the supervisors need to be careful. They should, at a minimum:

Conduct an independent study, outside the purview of Cal-ISO, to see what the city’s energy needs really will be in the future and how they can be met with renewables and conservation.

Direct the San Francisco Public Utilities Commission to prepare a plan to build the peaker facilities as a city project, with no private-sector partner getting control of the power for 10 years.

Guarantee the people of Bayview and the other southeast neighborhoods that if the peakers are installed, they won’t be fired up until the Mirant plant is shut down.

But there’s a larger point here. San Francisco has never had a detailed energy-options study that looks at how the city overall should address its energy needs for the next 25 years. A study like that would consider everything from tidal and wind power to public power, infrastructure needs, and extending the Hetch Hetchy line across the bay to CCA.

Instead, at the bidding of an unaccountable state agency filled with people who think like private-utility executives, the city is making a bunch of piecemeal moves that will create a patchwork of programs that may not be the right ones, may not be properly connected, and may not even be needed.

The only outfit that’s demanding we move quickly here is Cal-ISO — and before city officials decide to let the governor’s people determine our energy future, City Attorney Dennis Herrera should prepare a memo on what legal authority, if any, Cal-ISO has over the city and how San Francisco can defy that agency and determine its own future.*

Dust storm continues

The dust is still settling after a contentious Board of Supervisors hearing July 31 about public health problems allegedly related to the 1,500-unit condo complex that Lennar Corp. is building on Parcel A of the Hunters Point Shipyard. Department of Public Health officials succeeded in convincing a narrow board majority not to urge a temporary halt to the project but failed to reassure hundreds of mostly African American residents of Bayview–Hunters Point that their health has not been negatively impacted by Lennar’s inability to properly monitor naturally occurring asbestos and control dust at the hilltop site.

At the hearing, minister Christopher Muhammad of the Muhammad University of Islam, which lies adjacent to Parcel A, urged a shutdown and accused the city of "environmental racism," while Dr. Arelious Walker of the True Hope Church of God in Christ and Rev. J. Edgar Boyd of Bethel AME argued that the project is safe and beneficial to the community and that, in Walker’s words, there is "no evidence to warrant a shutdown." Many project supporters were brought in by Lennar on buses. Some observers called the clash "a holy war in the Bayview."

After the board voted 5–6 against a shutdown, there were angry allegations that some pastors had not publicly disclosed their financial interest in seeing the construction project continue. During the hearings, neither Walker nor Boyd disclosed that they had a contract with Lennar to build 200 homes on Parcel A. Reached by phone, Walker denied any self-interest in recommending that Lennar’s construction project continue. "My history disproves that," Walker told the Guardian. "If anyone unearths any evidence of harm, I’d back off my support."

The federal Agency for Toxic Substances and Disease Registry is doing an assessment based on a July 17 request by the Department of Public Health. In a public health assessment of Oak Ridge High School in El Dorado County, where naturally occurring asbestos was exposed during construction of a playing field, the federal agency found that athletes, coaches, and maintenance workers were "at higher risk [of exposure to asbestos] than previously thought," according to spokesperson Susan Muza. But while the agency recommended soil removal and landscaping, Muza told us it did not recommend the school be relocated or closed.

Meanwhile, Walker also rejects the notion that Bayview–Hunters Point is being torn apart by competing religious factions. "Minister Muhammad’s group has helped prove that there is a serious problem," Walker said. "I applaud him for that. We just disagree about the dust, but that’s not going to bring about a breach. I refuse to let there be a holy war."

Walker said his motive is more African American homeownership. But he learned how tough that is when he developed 20 town houses near Candlestick Point. "We wanted a 50 percent African American homeownership rate, but only two families ended up qualifying," Walker said, blaming "bad credit."

That raises questions about the likelihood that Bayview–Hunters Point’s predominantly African American and low-income community will be able to afford Lennar’s condos, with prices ranging from $300,000 for units required to be "affordable" (about 30 percent of the units) to $700,000 for market-rate units. Say goodbye to Earthlink

EDITORIAL EarthLink, the big technology firm that has been negotiating with San Francisco to build a free wireless network for the city and its residents, just announced a change in corporate strategy. On July 26, CEO Rolla P. Huff told stock analysts that the company would no longer pursue the sort of deal that San Francisco wants; instead, Huff said, EarthLink wants each municipality to "step up" and become an "anchor tenant."

That would mean San Francisco forking over millions of dollars a year to guarantee EarthLink some baseline revenue. It’s highly unlikely that the Board of Supervisors would agree to that sort of deal.

There’s no immediate indication of what this means for San Francisco. Some analysts think that the side deal between EarthLink and Google will provide enough revenue (with Google as the anchor tenant) to satisfy Huff’s demands. That’s impossible to say, however: the deal between the two tech companies remains secret (as does too much of this contract).

But there’s a chance EarthLink will pull the plug on San Francisco — and if it doesn’t, the company has made clear that it doesn’t want this sort of contract and won’t put much in the way of resources into making it work.

The way the deal was supposed to go down, EarthLink would provide free, if slow, wireless service all over town — although it wouldn’t work above the second floor of most buildings and might be difficult to use inside a lot of houses. A faster version would be available for a fee. And Google would sell ads based on users’ search terms.

We never liked the plan anyway. It seems foolish for San Francisco to turn such an essential part of its future infrastructure over to a private company. And now that EarthLink may be walking away, the supervisors ought to immediately pursue plans for a municipal broadband network.

Wi-fi is, and ought to be, only a small part of that plan. Wi-fi has limited use and range and is hardly a perfect solution to the digital divide. Sups. Tom Ammiano and Chris Daly have proposed that the city put fiber-optic cables under the streets anytime anyone is tearing up the pavement for other utility work. There are already public cables linking some city offices, and while creating a total network of underground fiber that could reach the door of every home and business would be a big undertaking, it would more than pay for itself in the long term.

While Mayor Gavin Newsom will be looking to blame the board for demanding more concessions from EarthLink, the company has created its own problems. And the Mayor’s Office, by agreeing to terms that let EarthLink and Google keep far too much information confidential and by defying the requests of community activists for more information about the deal, just made things worse.

At this point, with the economic model that Newsom and EarthLink identified losing credibility, the supervisors should make it clear: No more private contractors. No more outsourcing infrastructure. San Francisco needs municipal broadband — with wi-fi and fiber-optic cables — and the time to get started is now. *

Dust devils

A year has passed since Lennar Corp. officials admitted that subcontractor CH2M Hill failed to install batteries in dust-monitoring equipment at Parcel A, a construction site in Hunters Point Shipyard where an asbestos-laden hilltop was graded to build 1,600 condominiums (see "The Corporation That Ate San Francisco," 3/14/07).

The admission sparked a steadily growing political firestorm in Bayview–Hunters Point, further fueled by evidence that Gordon Ball, another Lennar subcontractor, for six months failed to adequately water the site to control dust and by a racially charged lawsuit in which three African American employees of Lennar allege they were subjected to discrimination and retaliation after they refused to remain silent about the dust issue. The lawsuit, set for a case management hearing Aug. 17, also claims that Ball committed fraud involving the Redevelopment Agency’s minority-hiring requirements.

Bayview–Hunters Point residents angry about the situation have found an ally in Sup. Chris Daly, who has called for a halt to construction at the site until an independent health assessment is conducted to the satisfaction of the community, including the Muhammad University of Islam School, which is adjacent to the Parcel A site and has been exposed to dust. The Board of Supervisors was scheduled to consider Daly’s resolution Jul. 31, after the Guardian‘s press time.

"This issue is of such a high level of importance," Daly told us. "There’s now a mandate for progressives in San Francisco to talk about environmental justice and to take action."

Sup. Sophie Maxwell, whose district includes the shipyard, told us that she understands the concerns of Daly and the community. "But when you get down it … the dust is inconvenient, but it is not harmful in the long term," she said.

Maxwell believes the city’s Department of Public Health should have done more outreach and updates, "but it has brought the situation under control." That sentiment was echoed by the city’s environmental health director, Dr. Rajiv Bhatia, who told us, "This is the first time we have implemented dust control, and this is an industry that had never been regulated. And in the end, things got better. We did our job in pushing a regulated community that grudgingly complied with our regulations."

In June, after residents complained that the dust was causing nosebleeds, headaches, and asthma, the DPH released a fact sheet that stated, "You may have heard there are reasons to worry about your health because of the construction dust generated by the redevelopment of Parcel A of the Hunters Point Shipyard. That is not true."

A July 5 informational DPH memo claims that when workers tried to do dust training and outreach at the end of June, their efforts "were significantly hindered by representatives of the Muhammad University of Islam," who allegedly disrupted training sessions, followed DPH workers, and told residents not to listen to the DPH workers.

On July 9, DPH director Mitch Katz testified at a hearing of the supervisors’ Land Use Committee that the city had imposed the highest standards possible to control dust. Katz also claimed that exposure to the dust was not toxic and that there is no proof that health problems were caused by the dust.

But at the same hearing, Nation of Islam minister Christopher Muhammad demanded testing "by people the community can trust," and he accused the city of "environmental racism." Noting that asbestos-related diseases often don’t manifest themselves for at least 20 years, Muhammad claimed, "The problem that we’re seeing in Bayview–Hunters Point is dust related."

After the DPH abandoned plans to do door-to-door outreach in favor of a series of health fairs, a coalition of activists calling itself POWER (People Organized to Win Employment Rights), some wearing masks and hazmat suits, closed down a July 17 homeownership seminar at Lennar’s shipyard trailer.

"Some folks did a picket outside, while inside, folks who own homes or live in public housing in the area were asking a lot of questions," POWER’s Alicia Schwartz told us. "We are for development that prioritizes the needs of low-income communities of color who have long been absent from the decision-making process, not development that puts the health and safety of families and the elderly at risk."

Two days later Marcia Rosen resigned as executive director of the San Francisco Redevelopment Agency. SFRA board member London Breed told us that the resignation was "a long time coming" and said she wished Rosen had taken a stronger stand on Lennar and Ball in the winter of 2006.

Breed says the agency "will always be a bad word to African Americans because of what happened in the Western Addition…. But we have a great opportunity in Bayview–Hunters Point to make it into something wonderful for the community."

Maxwell, whose grandson attended the Muhammad school’s Third Street campus, wonders why the minister refuses to move his students back to Third Street. "Lennar understands that this has become a PR nightmare and they are going to have to get contractors who are supportive of and understand the rules and regulations," said Maxwell, who is about to introduce legislation that she hopes will better control construction dust citywide.

Meanwhile, Dr. Arelious Walker of the True Hope Church of God in Christ told us that he and a group of like-minded pastors have formed the African American Revitalization Consortium, "a highly vocal and visible group in strong opposition to the shutting down of the shipyard without scientific proof."

"We support 100 percent the notion that the dust from Parcel A does not cause any long-term health risks. The project must continue because of its economic impacts. One little group does not speak for us all," said Walker, who met with Mayor Gavin Newsom, Maxwell, and Katz on July 23.

Acknowledging that the outcry over Parcel A has raised awareness of the dust issue, Walker said, "For years in the urban community, the environment was not the issue, but now we’ve woken up." Walker and his fellow ministers rallied about 200 people at City Hall on July 24 to express support for Lennar’s development and confidence in city officials.

Yet Daly said that faith may be misplaced: "It’s going to be a struggle to deal with the construction-related impacts of Lennar’s development at the shipyard, but the issue is much bigger, and it points to the need for an alliance between progressives, the African American community, and the southeast neighborhoods." *

Why Gonzalez didn’t run

So it looks as if there won’t be much of a mayor’s race this fall after all. I know that Matt Gonzalez took a hard look at it; he met with a good campaign consultant, talked to possible supporters and donors, took a poll … and decided that he wasn’t going to win.

Gonzalez didn’t want to run a symbolic campaign. He didn’t want to do what Tom Ammiano did in 1999 — galvanize the left, build a movement, and fall short of dethroning a powerful incumbent. Gonzalez felt like he did that once, and if he was going to enter the race, he wanted to know there was a real chance of victory.

But Gonzalez has been out of politics for a couple of years, and has dropped a bit off the political radar. His “maybe-I-will-maybe-I-won’t” game over the past six months has demoralized a lot of possible supporters. And he couldn’t come up with a plan to crack Gavin Newsom’s teflon: The early numbers had him losing, 60-20.

It’s too bad. I still think that if Gonzalez had started early, say back in January, we might have had a real race. I understand his frustration: No matter how badly Newsom screws up — Muni’s a mess, the murder rate is soaring, he slept with a staffer who was married to his good friend — the mayor remains almost impossibly popular.

That, I think, could change with a real candidate challenging him — but it won’t be Matt Gonzalez. So it’s time to start thinking about the Board of Supervisors in 2008.

The Chris Daly show

Oh, it’s so easy to make fun of Chris Daly. You can even make fun of his beard.

Or you can watch his much-derided speech at the Board of Supervisors, and recognize that: 1. He’s not a crazed nut; his points are cogent, well argued and entirely credible, and; 2. He’s right.

Daly is right: We should spend more money on affordable housing than on new roads. We should delay hiring more cops so we can save public health nurses. (Actually, we should raise taxes hire both cops and nurses, but that’s not in the cards right now.) The fact it, the mayor’s budget priorities are all screwed up.

Yes, budgets are always a compromise, and this district-elected board has done better, consistently, than any at-large board at keeping the mayor’s budgets relatively humane. I agree that Daly does himself no favors — and more than that, I fear that he does some harm to the cause of district elections. He says he cares nothing about his own political career, that he’s not a politician (which is one of the most charming and wonderful things about him), but he’s also part of a movement, and district elections is absolutely, utterly critical to the future of progressive politics in this city, and his fits of temper make the whole board look bad, and that helps the mayor’s candidates for supervisor and the people who would like to get rid of district elections altogether.

I think Daly needs to stop giving his enemies so much ammunition. There’s a lot more at stake here than one budget or one person’s future.

Still, I keep watching that speech, and I keep saying:

Shit, on the issues, the guy is right.

For all the crowing about the passage of Newsom’s budget (we’ll get to that soon), the progressive majority remains in the driving seat when it comes to setting priorities and making decisions at City Hall.

Consider two key votes that the progressives won at yesterday’s Board of Supervisors’ meeting.

First, Sups. Aaron Peskin, Chris Daly, Tom Ammiano, Jake McGoldrick, Ross Mirkarimi and Geraldo Sandoval voted for a charter amendment that will require the mayor to show up for monthly policy discussions at the Board. Their vote gives San Francisco residents the opportunity to clarify whether they really want to require that a monthly mayoral appearance be mandatory for anyone and everyone who holds the Mayor’s job.

In case you thought you’d already voted for this requirement last fall, the answer is, yes and no.

In 2006, 56.36 percent of San Francisco voters approved Measure I. But this was only a policy statement that asked, but did not demand, that the Mayor attend. And shortly after Prop. I passed, and with the progressives on the Board driving the policy on all the important issues of the day, like more foot patrol, more access to health care and a ban on plastic bag, Newsom sidestepped the will of the people, by declaring that he’d hold townhall meetings, instead.

Lest you are thinking, well, couldn’t the Board simply show up to these town halls and discuss policy there, the answer is, No, actually, they can’t. At least not without being guilty of massive violations of the Brown Act.

Months after local videographer and blogger Josh Wolf was released from federal prison — where his seven-month stay was the longest in history for an American journalist for refusing to turn over unpublished materials to criminal prosecutors — the San Francisco Police Commission finally has decided to analyze the incident. That inquiry comes just as Wolf embarks on a campaign for mayor, which he hopes will create a dialogue about the lack of police accountability and the overzealous federal intrusions that marked his story.

Wolf, 24, told the Guardian that he’s still baffled by what transpired after he filmed the July 8, 2005, anti-G8 protest, which involved a heavy anarchist turnout, "got rowdier than local officials would have liked," and left a San Francisco police officer with a fractured skull — an incident that Wolf calls "unfortunate" but of which he claims to have absolutely no knowledge

"I’ve read the evidence that was presented in my case, but to this day no one has pointed out anything that constitutes terrorism," Wolf said.

The day after the protest, Wolf was contacted at his home by members of the FBI and the Joint Terrorism Task Force, along with two San Francisco Police Department officers. The four agents who showed up Wolf’s door, one of them dressed in a Hawaiian shirt and shorts, demanded that he hand over all his video outtakes after local and national TV stations aired edited footage that Wolf posted on his blog. The aired film included scenes of anarchists setting off firecrackers, turning over newspaper racks, and spray-painting a Pacific Gas and Electric Co. office. It also showed an SFPD officer holding local resident Gabe Meyers in a choke hold while another agent waved his weapon at the crowd and shouted, "Leave or you’re going to get blasted. I’m a fed, motherfucker."

"If any time the SFPD decides it doesn’t want to deal with some local issue, does it have the autonomy to contact the feds, and if so, doesn’t that jeopardize all the laws that the voters of San Francisco have passed?" Wolf asked July 11 as the Police Commission discussed a resolution supporting the First Amendment rights of the "new media," which is how Web-based disseminators of news, such as Wolf, are being described.

Earlier this year, police commissioner David Campos tried to pass a resolution in support of the then-jailed Wolf, but the proposal got no traction until Theresa Sparks was elected as president in May. By then Wolf had been free from jail for a month, leading Campos and Sparks to shift their focus toward investigating exactly why Wolf’s case got federalized in the first place as well as the implications for other groups that are protected locally but at risk federally.

As Campos told the commission, "A lot of people in San Francisco have been talking about how we as a department interact with the feds, to the extent that it has an impact on medical cannabis providers and immigrants and on First Amendment rights, as in the case of Josh Wolf."

Under state law, reporters’ sources and their work products are protected. A recent case involving Apple suggests that the law also extends to bloggers and independent reporters. But under federal law, reporters have no such protections, which is why former New York Times journalist Judith Miller was jailed in the Valerie Plame–CIA investigation and San Francisco Chronicle reporters Lance Williams and Mark Fainaru-Wada faced potential jail time in the BALCO affair, as did freelancer Sara Olsen in the court-martial of Army Lt. Ehren Watada.

But while these journalists refused to comply with subpoenas that were clearly related to federal matters, there was no such obvious connection in Wolf’s case. An investigation into the assault on SFPD officer Peter Shields normally would have been undertaken by local police and District Attorney Kamala Harris. Police records show that SFPD inspector Lea Militello requested "assistance from the FBI/JTTF regarding investigation of a serious assault against a San Francisco police officer." Federal investigators justified their involvement by maintaining that there had been an attempted arson on an SFPD squad car purchased in part with federal funds, even though SFPD records indicate only that the car’s rear tail light was broken.

"There was nothing incriminating on my tape," Wolf told the Police Commission, recalling how he offered to prove his statement by letting the federal judge view it in his private chambers, an offer the judge refused. "But because I had no federal protections, I had to decide whether to engage in a McCarthyesque witch hunt," Wolf added; he long had suspected that the feds wanted to profile anarchists about whom he has intimate knowledge.

Campos and Sparks hope that last week’s Police Commission discussion will be the first in a series about the protocols and procedures that the SFPD follows in deciding whether to refer matters to federal authorities. Both stress that asking for such a study does not mean they do not care that an SFPD officer was hurt. As Sparks told us, "At this point we don’t know what the deliberations behind everything that night were or how many people were deployed. For us to comment on a police officer being injured is inappropriate unless we have all the information. And all we’re hearing is anecdotal stuff. Our job is not to take sides but to figure out what the policies were, are, and what they should be."

Police Chief Heather Fong has agreed to report to the Police Commission in August on policies and procedures related to the SFPD’s General Orders, the city’s ordinances on immigration and medical marijuana, and protection of journalists’ rights. Sparks predicts that the report will tell the commission "what the SFPD’s policies do, how that compares to the Board of Supervisors’ resolutions, and whether we need to rewrite them or write new rules for the police."

Commissioner Campos told us he hopes the report will clarify whether the police have an obligation to report to the feds if an investigation involves damage to property bought with federal funding. "If it’s the case that we are obligated, then we need a discussion. Do we want to accept funds if doing so ties our hands and forces us to do something that San Francisco doesn’t want to do? For instance, if we accept funding, then does that mean we have to cooperate with [Immigration and Customs Enforcement]? If so, then a lot of us, myself included, would be up in arms and would say, ‘Let’s not.’ To the extent that it comes down to money, I’d hope that we’d make the choice that we’d rather not take the money than get in bed with the federal government."

Wolf, who was not convicted of any crime but served 226 days for being in contempt of a grand jury subpoena, was released April 3 after he agreed to post all his unedited footage online — an action the feds claimed as evidence that he had submitted to their demands. But Wolf pointed out that he agreed to do so only after the feds promised that he would not have to testify about anyone whose actions or words he had captured on tape. He also pointed out that he released the tapes to everyone, not just the federal government.

Since being released Wolf has announced his intention to run for mayor of San Francisco this fall, saying he was inspired by the recent Progressive Convention called by Sup. Chris Daly "in which they had a great platform but no declared candidate."

Wolf’s candidacy pits him against Mayor Gavin Newsom, who expressed neither support for Wolf nor criticism of his detention. That stance is in contrast with that of Harris, who is also running for reelection this fall and publicly criticized the US Attorney’s Office in March, a month before Wolf was released. In August 2006, Newsom returned unsigned the resolution of support for Wolf’s plight that was sponsored by Supervisors Ross Mirkarimi, Tom Ammiano, and Daly. The resolution, which passed on a 9–1 vote, with Sup. Sean Elsbernd voting no and Sup. Michela Alioto-Pier absent, declared that the city "resisted the federal government’s intervention in the City and County of San Francisco’s investigation of the July 8th, 2005 G-8 protest; expressed support for the California Shield Law; and urged Congress to pass Senate Bill 2831, the Free Flow of Information Act."

Asked about Newsom’s position on Wolf and related matters, spokesperson Nathan Ballard reminded the Guardian that the mayor authorized a $10,000 reward for information leading to the arrest and conviction of the person or persons responsible for the assault on Shields. "We take these attacks seriously and will take the appropriate actions necessary to ensure that the person or persons responsible are prosecuted," the mayor said shortly after the assault. As for Wolf, Ballard said by e-mail, "I am not aware of any public statement [by] the Mayor on the case of Josh Wolf. The Mayor is generally supportive of the concept of a better shield law, but he has not taken a position on this particular bill at the present time."

As it happens, Wolf, who has made numerous media appearances since his release, including on The Colbert Report, could find himself in the unusual position of having more name recognition than any of Newsom’s other challengers. And with Congress currently considering a federal shield law, the cause for which Wolf went to jail remains in the news. As media activist Rick Knee put it, pointing to the "Free Josh Wolf" button that he continues to wear on the lapel of his tweed jacket, "Josh may be out, but the issue is still with us." *

Green City: Slow climate change U-turn

GREEN CITY It seems like most of the recent talk about global warming has been in terms of its apocalyptic potential in the distant future. Yet Bay Area heat waves and soaring temperatures in the Central Valley of late could certainly cause me to wonder whether it’s already begun. What has happened to our legendary cold summers and heavy rainy seasons? Sure, we’ve gotten patches of fog and wind, but for the most part this summer has felt, well, summery.

And apparently I’m not the only one thinking about climate change and what we need to be doing today to minimize it. Let me tell you, it’s going to take a lot more than driving a Prius and using energy-efficient lightbulbs to get the job done. That’s why the San Francisco Public Utilities Commission and the Department of the Environment published the city’s Climate Action Plan in 2004. The plan evolved from the Board of Supervisors’ 2002 resolution to reduce the city’s annual greenhouse gas emissions by 2012 to 20 percent below their 1990 levels and included a series of recommendations on how to achieve this goal.

In 1990, San Francisco emitted 9.1 million tons of carbon dioxide and other greenhouse gases, but by 2004 it was pumping out an extra 600,000 tons per year and counting. In order to get down to the ideal of 7.3 million tons by 2012, things need to make a major U-turn. Last month the San Francisco Civil Grand Jury released a report on how successful the Climate Action Plan has been so far, and while the city has made some progress in reducing its annual greenhouse gas emissions, the report noted that if the board’s goals are to be met, the entire city needs to step it up.

According to the grand jury report, the reduction of emissions in 2005 (the most recently available local emissions inventory) was "500,000 metric tons, only half the amount hoped," and "to achieve the reductions to 7.3 million tons by 2012 will require a tripling of the reduction rate."

The Department of the Environment remains optimistic. "We haven’t fallen behind," Mark Westlund, the department’s public outreach program manager, told the Guardian. "But we need to do more. We are currently at 1990 levels. At this point we’ve made the U-turn and are lined up to reach 7 percent [below] our 1990 levels, which would put us up to pace with the Kyoto Protocol’s goals, but we just need to ramp it up to reach our 20 percent."

City government can do a lot to control emissions. There are already regulations in place regarding the city’s vehicle fleets and setting green standards for municipal buildings. Mayor Gavin Newsom’s Green Building Task Force on July 11 announced a proposal to create incentives for private-sector buildings to adopt green building standards over the next five years.

Other city efforts include 2001’s Proposition B, which expanded solar power possibilities, and Community Choice Aggregation, which recently received preliminary approval from the Board of Supervisors; the latter program will allow the city to develop renewable energy projects on behalf of its citizens. But when it comes to making San Francisco a truly green city, much of the dirty work will fall to private citizens.

Nonmunicipal sources are responsible for 90 percent of San Francisco’s emissions, with a whopping 50 percent coming from private transportation, mostly cars. While the Climate Action Plan and the Civil Grand Jury report both give suggestions on how government agencies can motivate the public to reduce emissions, these suggestions can also be read as a map for how we can help ourselves. Simple changes in transportation habits — more walking, bicycling, and public transit — could cut 963,000 tons of greenhouse gases per year. And those who must use cars could carpool more often and switch to more-efficient vehicles.

The Climate Action Plan also indicates we can reduce emissions by an estimated 328,000 tons by changing how we live at home, including better energy efficiency and waste management.

Westlund told us, "Twenty percent is not just a municipal target, it’s citywide. Residences can help. Businesses can help. We’re all in this together. Getting the message out is half of it."*

EDITORS NOTES There was a fascinating moment July 11 at the San Francisco Board of Appeals meeting, a rare and revealing look into how city planning really works — and who calls the shots.

At issue was a proposal for two condo towers at Tenth Street and Market, one of which would soar 352 feet into the air — well above current height limits for the site. The developer also wants to put in 578 parking spaces, 399 more than the city Planning Code currently allows. It’s a monster of a project that would require seven planning code exceptions, two conditional use permits, and four zoning variances.

In other words, it’s not exactly what’s envisioned in the Planning Code for that particular lot.

But that didn’t bother Craig Nikitas, the city Planning Department staffer working on the project. In fact, in a long statement to the appeals board, Nikitas announced that city planners encourage developers to defy the current planning code since the planners think it’s outdated.

"The Planning Department encourages many project sponsors for tall buildings to use [a] height exemption," he said. That leads to "a taller building but a slimmer building…. That’s the kind of urban design we’re looking for nowadays."

Well, maybe — but the Downtown Plan, passed in 1984, calls for a very different type of design. It seeks buildings with setbacks (the so-called wedding cake look). That approach, which we all fought over in hearing after hearing before the Planning Commission and the Board of Supervisors, was designed in part to maximize sunlight at street level. That look may be old-fashioned architecture; it may not be what the current generation of planners wants. But it’s official city policy, city law.

If Nikitas and his boss, Dean Macris, want to change the guidelines for new buildings, there’s a procedure for that. You recommend changes to the Planning Commission, which can hold hearings and send new Planning Code changes to the Board of Supervisors. Then we all can discuss them in our usual, moderately civil, San Francisco fashion.

But that’s not how it works. Behind closed doors, the planners decide what they want the city to look like. Then they encourage developers to fit that model and bend the codes to make it all fit.

This is nothing new, but it’s rare to get such a clear admission, on tape, of why city planning in this town is so utterly screwed up.

In other news: there’s a bill before the State Legislature that’s supported by the San Francisco Chamber of Commerce and the Guardian. Labor likes it. The mayor likes it. The supervisors like it. And it could bring the city another $71 million a year in badly needed revenue (more than enough, for example, to solve Muni’s structural budget woes).

And yet it’s hung up in a Senate committee because Don Perata, the East Bay senator who is the president pro tem, doesn’t want any tax bills to go to the floor this year.

The bill by Assemblymember Mark Leno would allow — not require, but allow — the supervisors to put before the voters a proposal to increase the license fees on cars in this city to the level they were before Gov. Arnold Schwarzenegger cut them statewide. If San Francisco voters choose to tax their own cars, they will have the option; that’s all it is. Yet Perata’s press aide, Alicia Trost, told me it won’t even get a vote.

Tweeking the tidelands

With the furor over her erratic driving incident still lingering and a primary challenge from Assemblymember Mark Leno starting to get nasty, state senator Carole Migden is now wading into another potentially pungent political pool.

This time around, the battle involves the state’s laws governing coastal land use, the Port of San Francisco’s revenue needs, and the competing interests of folks who live along, work near, or simply like to relax and recreate along the city’s bayside waterfront.

Migden’s Senate Bill 815 would make three major changes to the ancient and arcane laws that govern the use of the state’s tidelands. It would allow the port to rent out 11 seawall-protected properties, currently used for surface parking lots, for development over 75 years, after which they would return to the public trust.

It would also permit the port to sell off "paper streets" — lots that serve as view corridors, public rights-of-way, and connections between the city and its waterfront, including portions of Texas, Custer, Ingalls, and Davidson streets developed with warehouses, as well as the recently closed Hunters Point Power Plant.

Last, Migden’s bill would allow the transfer of the 36-acre, federally owned Jobs Corps parcel on Treasure Island to local control as part of an exchange of public trust and nontrust lands on Treasure and Yerba Buena islands.

Port special project manager Brad Benson told the Guardian that the local agency worked with the California State Lands Commission for two years on ways to help increase the port’s revenue-generating capabilities, and this bill was the result.

"We cc’d the neighborhood organizations on the amendments that we sent to Migden’s office on June 12, and we invited further discussion," Benson said of the proposal, which is intended to help cover the port’s estimated $1.4 billion cost for seismic retrofits and restorations, hazardous-material remediation, storm-water management, and improved waterfront access by relaxing the land-use restriction of the 1969 Burton Act.

The Burton Act gave the port control of San Francisco’s waterfront from Fisherman’s Wharf to Candlestick Point, including 39 historic finger piers between Fisherman’s Wharf and China Basin. But it also limited the port to leasing seawall lots for street purposes such as surface parking while giving it the financial responsibility of maintaining and restoring the historical waterfront.

Today just about everybody agrees that surface parking is a horrible use of the seawall lots — with the possible exception of the Giants, who want to retain 2,000 spaces on the 14-acre lot they lease next to Mission Creek. But in recent weeks disagreement has broken out over last-minute amendments that were added to Migden’s bill June 20 to impose height limits on four seawall lots in the Northeastern Waterfront Historic District and remove a fifth lot entirely.

Those amendments were added following input from neighborhood groups like the Telegraph Hill Dwellers, the Barbary Coast Neighborhood Association, and the Friends of the Golden Gate, a 1,400-member nonprofit whose stated goal is "to preserve open recreational space for the citizens of San Francisco."

In a June 20 letter to Migden, Telegraph Hill Dwellers president Vedica Puri argued for height limits on the basis of a "visual and historic connection between the waterfront and Telegraph Hill" created by "higher structures closer to the base of Telegraph Hill and lower buildings near the Embarcadero." Noting that three of the disputed lots are currently zoned for heights of 40 feet, with the fourth lot, closer to Telegraph Hill, zoned for 65 feet, Puri argued for respecting local height limits in place as of January.

Meanwhile, the Barbary Coast Neighborhood Association, the Telegraph Hill Dwellers, and the Friends of the Golden Gate asked that lot 351, which abuts the Golden Gate Tennis and Swim Club, be excluded from the deal.

"There is an ongoing struggle in the Barbary Coast neighborhood over an outsize condominium project usually known as the 8 Washington Project," Jonathan Middlebrook of the association’s Waterfront Action Group warned.

Friends of the Golden Gate chair Lee Radner, in a June 29 letter to Loni Hancock, chair of the Assembly’s Natural Resources Committee, argued for keeping lot 351 under the public trust because it "abuts the open recreational space, along the Embarcadero, Washington, and Drumm streets."

"Lot 351, if removed from the public trust," Radner wrote, "will give a developer the option to build high-rise, exclusive, and costly condominiums that would spill over into the recreational space and change the open view corridors to Telegraph Hill and Coit Tower forever, limit the light and views of many neighbors, and impact the traffic on an already congested Embarcadero."

But two local planning and land-use groups argue that Migden’s amended legislation would wrest control of height restrictions from the local planning process and benefit a well-heeled few at the expense of everyone else.

Tom Radulovich, executive director of Livable City, said he believes height limits and urban design should be decided at the local level. "The problem with stipuutf8g a 40-foot height limit is that you end up getting squashed retail space, creating a pokey, unpleasant atmosphere," said Radulovich, who’d rather see the lots taken out of the bill than included with those provisions. "To my mind the question is: how do builders create a great street? And what building controls help achieve that goal? We wanted to make these lots more walkable, bikeable, and accessible to contribute to the overall public good with the maximum opportunity for local control. The latest amendments tip the balance towards state interference, and that’s inappropriate."

Tim Colen of the Housing Action Coalition accuses the neighborhood associations of "not wanting any height increases or other uses to the extent that it might threaten their view." Colen said developer Simon Snellgrove of Pacific Waterfront Partners is interested in lot 351, which lies across from the Ferry Building, to create high-end condos, mixed-use residential units, and 34 below-market-rate units.

He acknowledges that the Golden Gate Tennis and Swim Club would lose three tennis courts under the legislation. "But this is a chance for 34 families to get housing and be able to stay in San Francisco," Colen said. "The Golden Gate Tennis and Swim Club is a really sweet facility, but it ain’t public recreation. Migden’s bill benefits some very well-heeled people when the interests of many are at stake."

Migden’s bill, which cleared the Senate but must return for final approval because of the amendments, is set to work its way through the Assembly by August. Benson said continued negotiations would be a good thing. "We appreciate Senator Migden’s work, but we believe height limits are a locals-only matter to be decided by the Board of Supervisors and the mayor."

But the Barbary Coast Neighborhood Association’s Diana Taylor said her group "spent hours getting the community informed, telling the port what we wanted, until eventually we came up with a bottom line, what our compromises were…. That’s where senator Carole Migden developed amendments, and this was the first time that we came to a coordinated agreement. But now we find out that the port isn’t happy with some of the amendments. What we’d like to see is a more clear-cut strategy to bring the port and the communities together. We’re adversaries right now, but we shouldn’t be."

With the port set to have a public discussion July 31 about lot 337 (the Giants’ parking lot next to Mission Creek), Jennifer Clary of San Francisco Tomorrow notes that Mission Creek is home to 60 species of birds. As she said, "Isn’t habitat preservation and restoration part of urban development? Is it really a choice between people and birds? Is that the decision?"<\!s>*

Problems with Peskin’s Muni plan

OPINION Last week the Board of Supervisors received a proposed charter amendment that takes a misguided stab at the much-needed reform of the Municipal Transit Agency, which oversees Muni. In undertaking reforms we all agree are needed for the MTA to better serve our city, the supervisors should consider the Hippocratic oath required of doctors: “First, do no harm.”

Our union, Service Employees International Union Local 1021, which represents almost a thousand MTA workers, has enormous respect for the bill’s sponsor, board president Aaron Peskin. We know that Peskin strongly supports workers’ rights and has always stood for openness, transparency, and accountability in government. This initiative, however, undermines everything that he and his board colleagues stand for, and we urge progressives to oppose it.

Most important, the initiative is profoundly undemocratic and would transfer oversight from an elected body to an appointed one. An MTA that no longer had to answer to our elected representatives would be a less accountable and less transparent board.

Downgrading elected oversight into appointive power resting in the hands of one person — the mayor — is not reform but a political power grab. Commissioners would be well aware that they might not be reappointed if they voted too independently of the mayor’s preferences.

The initiative would present additional risks for the abuse of power in local government by allowing MTA to approve its own contracts. This is a dangerous conflict of interest that would create more opportunities for problems, not reform.

The amendment furthermore would undermine workplace protections by increasing the number of nonunion workers from the current 1.5 percent to a whopping 10 percent. Working people would serve at the pleasure of an unelected board and lose their right to collective bargaining. Seven years ago many members of the Board of Supervisors and progressives strongly opposed a nonunion special assistant position in Mayor Willie Brown’s office. The board converted this position to a civil service job because of the perception of patronage and corruption. The current charter amendment exhumes that political cadaver while hiding behind the fig leaf of flexibility — which in this case is a code word for the power to fire people without just cause or due process, or for political expediency.

On one point we agree with this charter amendment: it’s true that the MTA needs more money to serve our residents the way it should, and this amendment would take $26 million from the General Fund and transfer it to the MTA budget. But we do not believe we should be raiding the General Fund without carefully considering the possible impact.

This is a charter amendment and cannot be easily undone. If it turns out to be a disaster, as we believe it will, San Francisco will find itself in a very dire situation without a timely remedy.

SEIU Local 1021 strongly opposes this charter amendment unless it undergoes major revisions. Sup. Jake McGoldrick’s competing initiative, by contrast, offers us a path that is much more democratic, promotes accountability and transparency in government, and protects the rights of working families. We agree that reform is needed, but if passed, Peskin’s initiative will create many more problems than it purports to solve. *

Green City: Winds of change

GREEN CITY Atop Bernal Heights, winds speed at 25 mph, enough to prematurely slam doors, disperse heat, and power Todd Pelman’s Roscoe Street house with 100 watts of electricity at any given moment.

The 34-year-old engineer has pioneered the city’s first permitted micro–wind project, a six-foot-tall cylindrical turbine that currently sits on his roof and sends juice into the energy grid, offsetting some of his dependence on Pacific Gas and Electric Co. Now his company, Blue Green Pacific, is working to put the turbines on the market in the next year.

"It’s aesthetically not going to be disruptive in an urban environment," Pelman told the Guardian, referring to the generator, which resembles the double helix of a DNA strand when it spins.

It is microprojects like this that could help support the Community Choice Aggregation program passed by the Board of Supervisors last month, which aims to have the city partner with its residents to generate a greener power portfolio over the next 10 years.

Bernal Heights Sup. Tom Ammiano, who codrafted a plan for CCA with Sup. Ross Mirkarimi, considers Pelman’s project a grassroots step away from PG&E, which he regards as a "wolf in sheep’s clothing."

"When people see how fruitful and utilitarian this is, we’ll wind up calling the shots," Ammiano told us. He amended the planning code for Bernal Heights to permit structures to reach more than 30 feet high, thus allowing the current and future use of wind turbines in his district.

Pelman’s turbine will generate between 300 and 600 kilowatt hours of energy per year, or about 10 percent of a typical home’s energy needs, he told us. His vertical-axis turbine is a natural propeller system that spins on its axis — a contrast from the windmill-style horizontal-axis turbines characteristic of rural areas. It’s made of steel, aluminum, and plastic and contains no sharp blades that might endanger birds.

Urban wind, though plentiful, has not been widely used, mostly due to aesthetics and the space constraints of turbines, according to Johanna Partin, the Renewable Energy Program manager of the San Francisco Department of the Environment.

"The micro– and small urban wind market is still in the early stages of development," Partin said, pointing out that Chicago, the notorious Windy City, only recently started a residential permitting process.

Pelman’s turbine became the first in the city to receive a residential permit for use last Oct. 5 after numerous bureaucratic back-and-forths with the Planning Department.

His rooftop turbine captures wind energy coming from the coast and going east and sends it to an inverter in his garage that converts it to usable energy, which then travels into an electrical panel.

"Think of the turbine as the heart of the system and the inverter as the brain of the system," Pelman said.

While Pelman’s turbine may catch people’s eyes, he claims it does not do the same to birds. "It coexists very peacefully with the pigeons and the hawks," he said, mentioning a couple of Bernal Heights’ bird species.

He is working with the Audubon Society to make sure he can live up to his assertion. Due to the turbine’s opaque appearance, no birds have attempted to fly through and meet their doom — a problem frequently noted with the large, horizontal-axis turbines at the Altamont Pass Wind Farm.

A one-turbine system will cost around $5,000, though Pelman estimates that rebates will reduce the price by $1,500. It’s an "emotional purchase," he said, that will at least partially satisfy a green conscience.

Chris Beaudoin, one of Pelman’s first customers, decided to make wind energy his green cause. His Castro home of 20 years — located on what he calls "consistently windy" Kite Hill — is one of the 10 sites where Blue Green Pacific will initiate beta testing in the next six to 12 months.

As a flight attendant whose job has opened his eyes to locations where governments are stepping up to the plate in renewable-resource use, Beaudoin realized that "we can either bitch about [the lack of renewable resources] or politically agitate for it."

Beaudoin takes the ominous signs of global warming as a reason to act fast in every plausible way that he can. As he told us, "I think the main motivation is that we have to be ready for what’s going on down the road." *

I don’t think anyone except Gavin Newsom’s inner circle and the folks who run Google and EarthLink really likes the mayor’s wi-fi contract, but it now appears at least possible that the Board of Supervisors will approve some version of it.

Board president Aaron Peskin wants the service improved a bit and is demanding some written guarantees that it will actually work the way it’s supposed to. Some opponents of the deal are arguing that it ought to be treated as a franchise, not a simple contract, and they want more legal hurdles. The serious techies say it’s the wrong technology anyway and will be outmoded and worthless in just a few years.

But there’s something bigger going on here.

A high-speed broadband system for San Francisco isn’t a hot dog stand and boat-rental shop in Golden Gate Park. It isn’t a restaurant lease on port property. It isn’t the naming rights for Candlestick Park or a permit to operate a taxicab or deliver cable TV.

Those are contracts and franchises. This is a piece of municipal infrastructure; it’s more like the roads that cars and Muni buses use to carry people around town or the pipes that bring water to our houses or the public schools that educate our kids or the emergency communications system that takes the call when we dial 911.

This is part of the city’s future, part of its economic development, part of how its citizens will participate in the political debate, part of how we will all learn and think and talk to each other. This is the new public square, the new commons.

Why in the world would we want to give it to a private company?

I don’t care if EarthLink and Google are offering 300 kilobauds per second of download time or 500 or 1,000. I don’t care if they promise to give free laptops to anyone who can stand on their head and shout "search engine." I don’t care if they promise to paint every light pole in the city green. They are private outfits set up to make a profit for investors. They have no business owning what will soon be the city’s primary communication system.

San Francisco has kept private operators from controlling its drinking water. This water is considered a basic part of life, and it’s available at low cost: San Franciscans pay less than one one-thousandth the price of bottled water for the stuff that comes out of the tap, and it’s almost certainly better. Same with roads and bridges, police and fire protection, and basic education (although that’s still a struggle).

I don’t get why broadband is any different.

I don’t think this would ever have been an issue 50 years ago. The generation that survived the Depression (with massive public-sector investment and ownership) and World War II (with huge excess-profits taxes on big corporations) and built things like the interstate highway system and the University of California didn’t see government as evil and inherently dysfunctional. The public paid to invest in public services.

It was Ronald Reagan and his ilk who took a generation disillusioned by Vietnam and Watergate and turned it against the public sector (see "Needed: A Campaign Against Privatization," page 5). Now we’ve even got a privatized war (and look how well that’s going).

The supervisors should get beyond the wi-fi deal’s little details and think about what it really means. This is San Francisco. We know better.<\!s>*

The truth about housing money

OPINION Just as in war, in 2007 San Francisco budget politics, truth is the first casualty.

Nowhere is this more obvious than in the assertions by Gavin Newsom’s campaign minions that the mayor’s current budget proposal contains a $217.5 million city investment in affordable housing.

The purpose of these claims is to imply that Newsom has voluntarily allocated local tax dollars for this critical need — and that no more should be spent on affordable housing, especially some $10 million for lower-income rental housing production for families with children proposed by Supervisor Chris Daly and the Board of Supervisors.

The facts tell a different story.

First, the impression that this $217.5 million is all local tax money the mayor has voluntarily invested in affordable housing is false. Some $20 million is federal and state money that can be spent only on affordable housing. Another $25 million comes from local sources and also must be used for affordable housing. And $48 million comes from tax-increment funds mandated by a 2005 supervisors policy to go solely toward affordable-housing development.

So about 40 percent ($93 million) of the affordable-housing funding that the Mayor’s Office talks about was money that by law had to go to affordable housing. It wasn’t Newsom’s choice.

Nearly a third of the mayor’s budget for creating affordable housing — some $60 million — is in fact allocated to fund his Care Not Cash program, which was supposed to pay for itself. Indeed, more than twice as much money, $31 million, is earmarked to pay for privately owned, leased residential hotel rooms for temporary housing of the homeless (not producing one new affordable home) as is budgeted for the production of new, permanently affordable lower-income family rental housing ($15 million). The fact is, the 2007–08 Newsom budget cuts $24 million in funds earmarked for new affordable-housing production for families and seniors.

What is most distressing about the half-truths and nontruths in the affordable-housing budget battle of recent days is that the unity between the mayor and the Board of Supervisors — crucial to the expansion of affordable-housing opportunities for San Franciscans and which has characterized the city since the George Moscone administration (some 25,000 permanently affordable homes have been produced in the past 20 years, a figure unmatched in any other mayor American city) — has been placed in peril for short-term political advantage.

But cooler heads have prevailed inside and outside City Hall. Sometimes it is better to shut up and do what needs doing and let the credit fall where it may.

Which is why, when the dust settled last week, no one shouted about the $10 million that was quietly added back into the budget for permanently affordable family-housing production.

But we should all be clear: if we want San Francisco to be as economically diverse as we all claim, then we have only just begun to find the funds needed for more affordable housing. While it may or may not be true that you can never be too rich or too thin, it is most certainly true that San Francisco never allocates enough for affordable housing. *

Green City: People versus death monsters

GREEN CITY Pedaling or walking along a Panhandle pathway is the essence of green, a simple act of sustainable living and connection to a natural area within an urban core. It’s a calming, transformative activity — at least until you get to Masonic Avenue and the telling words painted on the path: "Death Monsters Ahead."

The death monsters, a.k.a. automobiles, that bisect this three-quarter-mile-long green runway into Golden Gate Park would be jarring even if traffic engineers had made that intersection the best it could be. Instead, it’s closer to the opposite — dangerous, illogical, and frustrating for all who must navigate it, a testament to what happens when the primary intersection-design criterion is moving cars rapidly.

After getting word of a rash of bicycle- and pedestrian-versus-car accidents at the Masonic-Fell intersection in recent months, Walk SF and the San Francisco Bicycle Coalition reinitiated (two years ago, it was the same story) a voluntary crossing-guard program on Saturdays and weekday evenings and lobbied City Hall to finally do something.

Sup. Ross Mirkarimi took up the cause, announcing at the June 26 Board of Supervisors meeting, "I find it simply unacceptable that the city has ignored the problem to the point where a volunteer program has become imperative. Traffic safety is a baseline city responsibility."

Mirkarimi is asking the San Francisco Municipal Transportation Agency, which has responded to years of complaints about this dangerous intersection with only minor and ineffective tinkering, to finally make a substantial change. He and the activists want a dedicated signal phase for pedestrians and bikes and a dedicated left-turn lane for cars coming off Fell.

It doesn’t take a traffic engineer to see what’s wrong with this intersection. Cars trying to turn left onto Fell from busy Masonic regularly get stranded by a red light and are stuck blocking the crosswalk. Even more dangerous is when bikers and walkers cross on their green light only to find cars — which also have a green light — turning left from Fell Street, cutting across their path.

The problem is vividly illustrated with too much regularity. I can still picture the female bicyclist who flipped through the air and crumpled to the ground a few feet from me after getting hit hard by a motorist. It was almost three years ago, but it remains a vivid, cautionary memory.

I was riding my bicycle west on the Panhandle trail, even with the motorist. Our eyes locked, his anxious and darting, and I knew he might try to cut me off, so I slowed. Sure enough, the driver made a quick left in front of me and hit the bicyclist coming from the opposite direction, who assumed that the green light and legal right-of-way meant she could continue to pedal from one section of parkland to the next. Instead, she joined a long list of Fell-Masonic casualties, to which attorney Peter Borkon was added May 19, a few days shy of his 36th birthday.

Borkon was on his road bike, training for the AIDS Life Cycle ride, when he cautiously approached the intersection, slowed, and unclipped from his pedals. When the light turned green, he clipped in, crossed into the intersection, and then, he says, "I was run over by a Chevy Suburban."

He was hit so hard that he broke his nose and gashed his face on the car, an injury that resulted in 15 stitches, and was thrown 10 feet. The fact that he was wearing a helmet might have saved his life, but he nevertheless went into shock, spent a day in the hospital, and is still waiting for the neurological damage to his face to heal.

How dangerous in that intersection? When I asked the MTA for accident statistics, a response to the criticisms, and a plan of action, public information officers Maggie Lynch and Kristen Holland first stonewalled me for two days and then said it would take two weeks to provide an answer.

Maybe Mirkarimi will spark a change, or maybe the MTA will just keep doing what it’s always done: plod along at a bureaucratic pace with tools ill suited to an evolving world that must do more to facilitate walking and bicycling as safe, attractive transportation options, even if that means delaying the death monsters.*

The golf club

For the better part of a century, San Francisco’s public golf courses have offered players relatively inexpensive rates, belying the view of some that this is an elitist sport incompatible with progressive civic governance. But since a botched revamp of the Harding Park course several years ago, golf operations have landed in the rough, siphoning large sums from city coffers every year. Now Mayor Gavin Newsom and his Recreation and Park Department claim that private businesses would do a better and cheaper job of running three of the city’s most valuable links.

Sup. Jake McGoldrick and other privatization opponents say outsourcing control of the Harding, Fleming, and Lincoln courses would inevitably lead to less access for the general public and higher costs. "A lot of folks don’t realize that the Golden Gate Yacht Club and the St. Francis Yacht Club are public assets that are now run as private membership clubs, elitist things," McGoldrick told the Guardian. "That’s certainly the way this could go."

McGoldrick has called for the formation of a Golf Course Task Force to explore nonprivatization solutions, including converting some of the courses into parks or open space, as the Neighborhood Parks Council has urged. On July 10 the Board of Supervisors will decide between McGoldrick’s plan and Rec and Park’s "hybrid management" resolution, which would award leases of 20 to 30 years for the courses. Political handicappers say the vote could go either way.

In addition to their concerns about prices and accessibility at privately run links, McGoldrick and others have serious reservations about who will run the courses if the mayor’s plan succeeds. No one we spoke with could name potential bidders with any certainty, but if the past is prologue, the choice is likely to involve political cronyism.

Golf advocate Sandy Tatum engineered the deal that turned Harding Park over to the management of Kemper Sports, which has been accused of overspending public funds and turning the course into a huge drain on the city treasury. Kemper also rents space to Tatum’s First Tee program. More recently, another nonprofit started by Tatum and former city attorney Louise Renne initiated and funded a study for Rec and Park that recommended more privatization by turning over courses to entities such as theirs.

The SF Weekly, which has run stories critical of the city’s golf privatization scheme, revealed a 1990s deal that privatized a city-owned course near Burlingame and, in what it deemed a corrupt selection process, handed control of the course to former Willie Brown staffer Tom Isaak.

In 2004, Tom Hsieh, one of Newsom’s key campaign consultants, submitted the sole bid for control of Gleneagles Golf Course in McLaren Park. Neither Hsieh nor his business partner, real estate investor Craig Lipton, had ever run a golf course before winning the contract for Gleneagles. But what really raised eyebrows around City Hall were the terms of the deal. Any lease of more than 10 years would have needed approval by the Board of Supervisors, so Hsieh and Lipton were given a nine-year contract.

"That was a very obvious and blatant end run around the contract requirements of the Board of Supervisors," McGoldrick told us. Hsieh, he went on to say, "is one of the mayor’s good buddies, and he got himself a nice contract out there."

Rec and Park spokesperson Rose Dennis defended the lease agreement with Hsieh, telling us, "At the end of the day, he legally got the concession. It wasn’t like it was put down to a nine[-year contract] to screw anybody. That would suggest a level of sophistication that Rec and Park just doesn’t have."

Reached for comment, Hsieh bristled at the suggestion that he landed the contract because of his ties to the mayor, writing in an e-mail that the mere suggestion was "a scurrilous attack motivated by politics." Hsieh did not answer our repeated requests for information about wage levels at the Gleneagles course and the number of groundskeepers employed there. McGoldrick and sources in the industry assert that one of the main ways private managers would make money from the other courses would be to reduce labor costs.

Sup. Sean Elsbernd, one of the privatization plan’s strongest backers, conceded that some past golf contracts have been "questionable," specifically in the case of Hsieh’s deal. But he said the supervisors would oversee the leasing process this time to avoid cronyism and the kind of spending excesses allegedly committed by Kemper Sports. They would also mandate that new managers continue to employ union employees.

Unlike the city, Elsbernd argued, private businesses could invest large sums of money in rehabilitating the courses, especially Lincoln. "When it gets that kind of [cash] infusion," Elsbernd said, the course "is going to see a turnaround in revenue so that you can actually justify charging higher fees."

That is exactly the kind of scenario privatization foes fear: more exclusive golf courses on public land that raise greens fees beyond ordinary people’s means. "These courses are untapped gold mines," said golf instructor, former pro, and activist Justin Hetsler, who has formed a nonprofit group, Golf San Francisco, to lobby against the mayor’s plan. "But every penny spent at the courses should go back into them, not into someone’s pocket as profit." As for capital improvements, Hetsler, who also works as an accountant, argued, "The courses’ future revenue streams can secure credit for improvements. That does not require privatization."

For McGoldrick, this debate is about far more than golf courses. "I don’t even play golf," he told us. The push to outsource control of the links, he said, reflects a larger philosophical battle about what to do with publicly owned resources. "The mayor is a pro-privatization kind of guy. That’s his MO…. We’re seeing this happen all over the place, not just San Francisco. But for me, it’s just painful to watch city assets [be] given away. It really kicks me in the gut." *

City Attorney Dennis Herrera issued a statement at about 7 PM tonight, concerning Sup. Jew’s reply brief
to the Attorney General’s in Quo Warranto Action–and Herrera sounded none too pleased.

Maybe it was because Jew’s attorneys filed the beleagured supervisor’s reply brief just moments before the close of business today, (when most of the City had already left early in preparation for July 4.) Or maybe Herrera was incensed by Jew’s attorneys, who are arguing that City Attorney Dennis Herrera’s quo warranto petition, which seeks permission to sue for Jew’s removal from elective office, should be denied.

In a nutshell, Jew’s attorneys say that the City Attorney’s civil case should be stayed pending the adjudication of criminal charges against the District Four supervisor, which means, until the feds are done with him.

All of which got City Attorney Dennis Herrera issuing the following statement, which should be read while drinking beer, watching the fireworks and reminiscing on your favorite Ed Jew story:

“The citizens of San Francisco have a right to legitimate representation in their democracy that clearly outweighs the right of one politician to remain in office in violation of the law. The evidence is overwhelming that Supervisor Jew failed to meet the basic residency requirements to seek or continue to hold his office. It would be a terrible injustice if the legitimacy of our Board of Supervisors were to remain in doubt for the duration of a criminal process, which could take years.”

Herrera’s response brief is due to Attorney General Jerry Brown by July 13, 2007. Thirteen, Huh? That should be interesting. In the meantime, to review all the materials the City Attorney’ has collected as part of this investigation check out www.sfgov.org/cityattorney/ .
