Alice Waters protested for supporting using human waste as compost

In a story that continues to amuse and fascinate, it appears that the human biosolids compost shit show we wrote about last week has left town… and ended up in, of all places, Alice Waters’ own backyard garden. That’s right: the seasonal, local, and cage-free proprietor of Berkeley’s fabled Chez Panisse has emerged as a staunch and unlikely defender of fertilizing your garden with sewage sludge compost, which San Francisco officials have recently discontinued giving away because of environmental concerns.

It all started when the Organic Consumers Association found out that Francesca Vietor, executive director of Chez Panisse’s non-profit arm promoting safe and healthy food for kids, was the same Francesca Vietor who is vice president of the SFPUC Board of Commissioners, which had until very recently been pawning off toxic compost made from human waste contaminated with industrial chemicals and heavy metals.

The news was like finding Mom (Chez Panisse) in bed with a Hells Angel (the SFPUC).

But we understand organizational slip-ups happen, and we trusted Waters to do the right thing, issue an apology, and figure out what to do with Vietor. But it turns out that the Bay Area’s advocate for a slow food economy that is “good, clean, and fair,” has decided instead to stand in defense of a system that is, frankly speaking, fast, cheap, and out of control.

On March 23, OCA National Director Ronnie Cummins wrote a letter to Waters asking how this could be. The letter reads, in part:

“Considering that the sludge was given to several local schools for use on their educational gardens, your work with the Edible Schoolyard should especially elicit your concern. This is certainly in direct opposition to the standards that Chez Panisse Foundation and the Edible Schoolyard encourage and uphold. It seems to us a clear conflict of interest that Francesca Vietor should serve as both the Executive Director of the Chez Panisse Foundation and the Vice President of the PUC.”

Waters wrote back March 30:

“I have been involved with the organic garden movement for 40 years. I believe in the transparency of public institutions and count on the government to offer the highest standards outlined by the Organic Consumers Association and other reliable advocates. I look forward to reviewing the science and working with the SFPUC to ensure the safety of composting methods.”

Well, the science is already in, and as we reported, it isn’t pretty; and more, our public institutions aren’t that transparent either, especially when it comes to sewage sludge compost. So on April 1, the OCA plans to hold a protest at noon to commemorate Chez Panisse Café’s 30th anniversary and perhaps remind the East Bay bastion of sustainability why diners have patronized them for so long.

Remember in Basquiat when David Bowie’s Andy Warhol crows, “you always get the good stuff,” to dealer Bruno Bischofberger (Dennis Hopper, in an equally meta bit of casting) over their power lunch? Well, that’s how I felt when I read the news on Fecal Face that uber-cool-for-Mission-School gallery Jack Hanley is closing shop in SF to focus on its New York space. If you want to pour out some beer on the corner of 15th and Valencia, the SF institution’s final show opens this Saturday. It’s a family affair, including work by old and new Hanley favorites such as Tauba Auerbach, Chris Johanson, Alicia Mccarthy, Shaun O’Dell, and Leslie Shows.

In more encouraging gallery-related news: last Friday, the GLBT Historical Society’s Dom Romesburg sent out an email announcing that the org just signed a lease for, “a new Gay, Lesbian, Bisexual, and Transgender Historical Society History Museum in the Castro.” Romesburg continues, “The new exhibit space is on 18th near Castro, in the old laundromat right across from Magnet.” This is indeed exciting news, as the rotating exhibits at the Society’s intimate downtown space, along with Passionate Struggle, last year’s long-running panorama of SF LGBT history in the old Wolf Camera shop on Castro Street, have largely been great, but have also felt like so many amuse-bouches for what must be some pretty fabulous main-course holdings (Sylvester’s Purple People Eater sequined stage costume, one of Passionate Struggle’s highlights, notwithstanding).

Introducing Fossil Fools Day

“The fossil fools ain’t no joke – but that doesn’t mean we can’t fight them with one,” say activists at www.fossilfoolsdayofaction.org as they announce plans to pull pranks April 1.

Citing destabilization of the global climate, and the inconvenient truth that communities from Alaska to Alberta to Appalachia are being destroyed by dirty energy extraction and combustion, super hurricanes, droughts, Rising Tide North America charges that in December 2009, politicians in Copenhagen, “sold us out to the fossil fools, corporate lobbyists and big banks.”

“Now we’re left with ‘green capitalism,’ carbon market shenanigans and continued assaults on our communities and ecosystems,” Rising Tide states. ” If we’re going to stop climate change, the only real solution is to keep fossil fuels in the ground.”

They are promising to convert the usual April Fool’s Day jokery into Fossil Fool’s Day, by “pulling some pranks that pack a punch.”

In the Bay Area, some of these self-described clowns plan to pay a visit to Chevron “to send a message that fooling around with fossil fuels is fooling around with our future.”

Rising Tide North America spokesperson Sarah Hampton told the Guardian that interested parties are invited to meet at 6:45 am, April 1 at Ashby BART station in Berkeley “to make noise and theater and educate the local public about our demands to Chevron and the atrocities that Chevron is responsible for globally.”

“We are not announcing where we will be going,” Hampton clarified. “But if folks want to get involved, they are welcome to meet at Ashby BART station, dressed like clowns and bringing musical instruments, as long as they are not planning to be violent.”

Building better buses

GREEN CITY To hear Jaimie Levin talk is to understand that his cause is larger than just promoting alternative fuels for public transportation. “We either pay the tax ourselves or we pay the tax of sending money to the Middle East,” he said as we walked through the noisy AC Transit bus yard in East Oakland. “There’s a human cost of lives lost in a foreign war.”

AC Transit uses 6.5 million gallons of diesel per year. As the agency’s director of alternative fuels policy, it’s Levin’s job to lower that number. He has experimented with biodiesel and gas-electric hybrid buses. But the passion that consumes him these days is hydrogen. He has spent the last 10 years testing and deploying three hydrogen fuel cell buses for AC Transit, and he’s ready for more.

The first of 12 new hydrogen fuel cell buses begin arriving from Belgium at the end of April, doubling the number of fuel cell buses operating in the United States. They will run on multiple lines, including the 57, 18, and the NL transbay route, which runs between San Francisco and Oakland.

Levin promotes a mix of energy sources, but he argues that hydrogen is the best way to go, even if there’s a big near-term problem: the price of a hydrogen fuel cell bus. The new buses cost $2.5 million each compared to a standard diesel bus, which runs $400,000. Levin describes the buses as research vehicles and works with the National Renewable Energy Laboratory to monitor their performance.

“It’s not cheap. We understand that. These are still hand-made. We’re talking about making less than 20 vehicles,” he says. Levin is hopeful that if orders for hydrogen fuel cell buses could reach even 200, the cost of the fuel cells would come down by 45 percent. Levin has secured 16 different grants from federal, state, and regional agencies, ranging from the Federal Transportation Administration to the California Air Resources Board, to cover the $57 million program. The use of outside funds has been critical at a time when AC Transit is cutting service to deal with its budget shortfall.

The cost of the hydrogen fuel itself has caused some to ask if it’s a viable alternative to gasoline. A kilogram of hydrogen, which is equivalent to a gallon of gas in terms of energy content, typically costs $7-$8. But hydrogen fuel cells are twice as energy efficient as internal combustion engines.

AC Transit currently gets its hydrogen fuel from its own production facility that it built with Chevron, which is regularly criticized by environmental and human rights groups for everything from pollution to obscene profits to support for despotic regimes. “Chevron Hydrogen” billboards plaster the bus yard, and the logos are yellow and baby blue, a noticeable difference compared to the traditional blue and red Chevron insignia. There’s an ecofriendly, sunny quality to the branding.

But come September, Chevron will exit its collaboration with AC Transit, which will begin purchasing its hydrogen from a Linde plant in Southern California. Part of the reason is that the Chevron-designed system does not have the capacity to produce hydrogen for 12 buses. Industry watchers note that oil companies have scaled back initial forays into hydrogen, perhaps not wanting to facilitate the transition from fossil fuels.

“The big issue is the infrastructure side. What’s cooling it off right now is how far the oil companies have backed off,” said Tim Lipman, codirector of the UC Berkeley Transportation Sustainability Research Center. “If you’re an oil company, you’ve got to figure you’re going to lose money for a while — and you’re making tons of money in your existing business. It’s not broken right now. They don’t see an advantage of being the first to market. We’re not running out of oil.”

Maybe not yet, but between the global warming impacts of oil and the increased cost of extracting oil after the most readily available supplies peak, there is a pressing need to develop alternatives to fossil fuels.

“The oil companies were getting all sorts of pressure to get off oil and carbon so they go out looking for an alternative that looks good and takes the longest to implement. Hydrogen is perfect,” said David Redstone, editor of Hydrogen and Fuel Cell Investor, who has covered hydrogen for more than 10 years.

After studying hydrogen for so many years, Redstone has become skeptical about its real potential. “I was a believer when I started,” he told us. “I learned a lot. I knew a lot less when I started. I knew a lot less about the engineering and cost issues involved.”

For example, fuel cells require platinum, which acts as a catalyst to help burn hydrogen fuel. There is ongoing research to reduce the amount of platinum needed in a fuel cell, and exploratory work with less expensive catalysts like nickel. But for now and in the foreseeable future, hydrogen is still a very expensive technology. “They’ve been demonstrating these fuel cell buses for 20 years. It’s like the mentality at the companies involved is that it’s perfectly normal to be a demonstration technology forever,” added Redstone.

He believes that the realistic solutions to the overuse of fossil fuels lie in a mix of behavioral changes and economic incentives, not technological silver bullets. Stop suburban sprawl, get people to live closer to work, and start taxing carbon. Or in Redstone’s simpler terms, you’ve got to put an end to “assholes commuting 75 miles to work in a Hummer.”

The International Panel on Climate Change estimates that surface temperatures will rise 2 degrees to 11.5 degrees Farenheit in the 21st century. Greenhouse gas emissions are a major contributor to global warming.

The promise of hydrogen fuel is that its only emission is water. The major criticism of the move toward battery electric plug-in vehicles has been that the power to charge batteries comes from a power grid that is frequently a heavy greenhouse gas emitter. Half of the electricity generation in the U.S. comes from coal, the dirtiest of the fossil fuels.

But the hitch with hydrogen fuel is how to make it. You can’t drill for hydrogen, you have to create it in a process that requires energy. The predominant source for hydrogen fuel is natural gas, which emits less carbon than gasoline but is still a fossil fuel.

The holy grail of alternative energy is an efficient method for making hydrogen fuel from water instead of natural gas. The problem has been the significant amount of energy required to electrolyze water, to split apart H2O to make hydrogen fuel.

Levin believes he has the beginning of an answer. Before the end of 2010, AC Transit will complete its installation of a solar-powered proton electrolyzer in Emeryville. Solar panels will be built atop the roof of the hydrogen fueling station and the solar energy trapped will power the electrolyzer, in turn producing hydrogen fuel from water, hopefully about 60 kilograms per day, enough to power two buses. Levin received $6.4 million from the American Recovery and Reinvestment Act for the project. The remaining 10 hydrogen fuel cell buses will rely on hydrogen fuel made from natural gas.

As important as the production of hydrogen fuel are the pump stations to deliver it. Gov. Arnold Schwarzenegger’s promised “hydrogen highway” hasn’t happened. The initial plans called for 50 to 100 stations by the end of 2010, and a station every 50 miles, but there are now just 21 stations clustered in urban areas. And with oil companies withdrawing their support and government agencies hurting for resources, the hydrogen highway remains as far off as ever.

“I see the power of corporations growing and the power of politicians actually waning,” Lipman said. “Who is really going to benefit the most? It’s society and consumers, but they’re not going to lobby for it.”

When it comes to lobbying, few can outgun the power of the Western States Petroleum Association. WSPA is consistently among the top few lobbyists in California, spending $10.5 million to influence the Legislature in 2007-08. Even with the push for alternative energy options, it’s oil that really governs the debate. Relatively inexpensive and easily storable, oil is still king even as gasoline prices hover at $80 a barrel.

“We will never run out of oil, but the question is, can we afford it?” said WSPA spokesperson Tupper Hull. Rising oil prices have helped proponents of alternative energy because the cost spread between gasoline and other energy options has narrowed. But they worry that momentum will be lost if the recession lingers and oil drops in price.

Proponents of the “peak oil” theory say we are approaching a point at which global oil production will start declining, necessitating a rapid and potentially painful transition to new fuels. But identifying the peak is difficult, complicated by events such as the 2007 discovery of more than 5 billion barrels of oil off the coast of Brazil. The oil field was found under 7,060 feet of water, 10,000 feet of sand, and another 6,600 feet of salt. What the oil industry is ultimately worried about is whether we will hit a point where extracting oil gets so expensive that the cost of oil starts to cripple the global economy. Drilling four miles under the sea isn’t cheap.

In an e-mail exchange about Chevron’s AC transit hydrogen fueling station, Chevron spokesperson Brent Tippen wrote, “Hydrogen has potential as a transportation fuel in the long term, but significant technical and economic obstacles prevent it from being a widespread commercial fuel option right now.”

Levin is cautiously optimistic that it could be the gas companies like Linde and Praxair, and not the oil companies, that carry the hydrogen torch forward.

After a brief ride in a hydrogen fuel cell bus, Levin noted how quiet they are. At one point, he bought Tibetan bells and had them welded to the bus so it would be audible as it moved, but there wasn’t enough vibration to make them ring.

Therein lies Levin’s dream: a quiet, nonemitting vehicle for public transportation. And maybe even someday an entire society running on a clean, renewable, domestic fuel source. But for now he’ll start with what he’s got: a $2.5 million bus that emits water from the tailpipe and doesn’t make any noise.

You have to take the dog for a walk anyway, right? Why not stop in at your friendly neighborhood dog bar along the way? A few local bars make a point of catering to the canine crowd; here are some places where your (well-behaved) pet is welcome.

 

STRAY BAR

With its motto of “Sit. Stay. Drink.” and Smurf-esque French bulldog logo, Stray Bar flaunts its fur-buddy friendliness, and the bartenders always make sure to keep the dog-treat and water bowls filled. People amenities include a darts room, a TV (usually tuned to a sports game), a jukebox with a healthy cross section, and a few ample leather couches. The crowd tends toward the unpretentious and neighborly, so if you happen to see a grizzled fellow totter on by, greet him with a raised glass and a pat on the head — that’s Camden “the drunken sailor,” the owner’s beloved pooch, just making his usual rounds. Some rules to keep in mind: keep your pup on a leash and off the couches, no doggie roughhousing, and, of course, if you don’t clean up any mess your furry friend should make, you will be summarily ejected and banned. Also, for crowd and animal safety, don’t bring your four-legged pal on Fridays and Saturdays or during special events.

If you and your dog are of a more dive-bar-patronizing persuasion, trot on over to Lucky 13. (People treats usually range from free popcorn to cheese Goldfish.) Other fun bits include a pool table, a photo booth, and, best of all, an outdoor patio to give your dog a stretch and a breather — as long as you don’t mind sharing the air with smokers. Although pups can wander off their leashes, the basic tenets of responsible pet ownership still apply. Don’t let your dog act in any way that would, if you were to do the same, get you tossed out or arrested.

If, on the other hand, you are both creatures of finer tastes, seeking a more elegant excursion, take a walk to the Fireside Bar. At this modern-minded and cozy lounge, the purple walls and dark leather furniture strive for a chic ambience, and sofas are set up around — you might have guessed — a fireplace. It’s a lot like drinking in someone’s classy living room — someone who doesn’t mind your bringing over the dog. The bartenders also seem to be phenomenally friendly, and the eclectic jukebox plays everything from Flogging Molly to jazz. Dogs must always be on a leash, and water bowls are set out in case it gets a little too toasty.

ALBATROSS PUB

It’s games galore at the Albatross Pub, the cheerful and spacious bar that describe its atmosphere as the “guts of an old wooden pirate ship.” Besides a pool table and a darts shooting gallery, Berkeley’s oldest pub boasts 17 types of board games to tickle patrons’ competitive spirit. Be wary, though: Connect Four always gets nabbed first. Yarr. If gaming doesn’t set your heart aflame, you can occupy yourself listening to the live music sets and sorting, or drinking your way, through the decent selection of Scotches, bourbons, whiskeys, and Belgian-style beers. One buck gets you an unlimited pass to the popcorn machine. Dogs must be on leashes and at the tables, so don’t sidle up to the bar with your furry companion in tow. And here’s one of the most important rules: dogs must be out by 8 p.m. Consider the Albatross the perfect place to stop by for a sip or two on your pup’s evening constitutional.

Homestead’s a lot like other Mission joints — cheap strong drinks, $2 Tecates, and a hipsterish crowd peppered with some normal folks (although according to Yelpers, an unusual number of attractive people seem to congregate here, so use that tip for whatever you will). The bevy of topless pinups hung on the walls sets the bar apart, as does the gorgeous Victorian decor, holdovers from and nods to the establishment of the first bar on the site in 1905. You can also look forward to free peanuts. The rules for dog patrons are on par with the ones at Lucky 13. Dogs can wander around without a leash, but don’t be an irresponsible a-hole pet owner. Treats and water bowls are available.

A 40-year Last Gasp that’s getting stronger

Last Gasp, San Francisco’s landmark independent and underground publisher, is turning 40. To celebrate this feat – in four decades, Last Gasp has spawned more than 300 comics and 250 books – it is throwing a party and an art show Thurs/April 1 at 111 Minna Gallery.

Who dared wager, in the mid-1970s, that Last Gasp would survive the withering of the underground comix scene? Head shops, the main outlet for unedited explicit sex-, drug-, and violence-ridden content (the “x” in comix stands for X-rated), were being prosecuted and forced to shut down due to anti-drug paraphernalia laws. Comics stores favored the more mainstream adventures of masked men in tights. Finally,“there wasn’t the same appetite for comics anymore,” according to Colin Turner, associate publisher to his dad Ron, who founded Last Gasp. No matter: the small venture outlived its peers by continually adapting, tuning to consumer demand and catering to bookstores’ standards and their stapled-leaflet scorn. Over the years, Last Gasp branched out into artist monographs, coloring pads, music-related books and graphic novels.

Yet, browsing its odds-and-ends catalogue, one gets the sense that Last Gasp hasn’t compromised its bizarre and satirical bent. Sure, it might carry such mundane items as coloring books, but beware of the twist! Gangsta Rap Coloring Book flaunts 48-pages of line drawn gangsta rappers. As for Tee Corinne’s Cunt Coloring Book, well, the title says it all. Last Gasp may have diversified, but it never reneged on complete artistic license, the hallmark of underground comix.

Today, Last Gasp thrives in the areas of lowbrow art and pop surrealism. Lowbrow is an umbrella label for “art forms that are popular and wonderful, that people love, but that aren’t respected in the fine art world”, according to Colin. It ranges from tattoos and Kustom Kulture to street art and graffiti – artistic expressions rooted in pop culture that take place on canvases ranging from car exteriors to skin..

As for pop surrealism, the genre emerged from cartoon-y visuals only to reclaim traditional old master painting craftsmanship. Artists such as Scott Musgrove, Camille Rose Garcia and Mark Ryden colonize canvasses with impeccably-rendered phantasmagorical creatures and weird visions. Neglected for years by art institutions, the loose-knit community of lowbrow artists is gradually being endorsed by upscale galleries and museums, a shift that once again attests to Ron Turner’s prescient flair. Back in the day, he promptly discerned underground comix’ wide appeal and cultural relevance, supporting the work of then-young and aspiring artists such as R. Crumb, Bill Griffith, and Spain Rodriguez, all of whom matured into cult or mainstream icons.

It could be said that Ron Turner got sidetracked into publishing. In the late 1960s, the Fresno native enrolled in the SF State psychology department. The Peace Corps volunteer, freshly returned from a stint in Sri Lanka, was thrust into the Bay Area countercultural upheaval and its myriad of grassroots movements. As a Berkeley Ecology Center activist, he figured that he could raise funds by releasing an environmentally-oriented comic book.

“I thought the graphic approach would engage teenagers, help them thwart authority figures, and provide answers to ecological concerns”, Ron recalls. With the mentorship of Gary Arlington, the San Francisco Comic Book Company owner who was selling Zap Comix under the counter, he compiled and printed 20,000 copies of Slow Death Funnies 1. By that time, his Ecology Center accomplices had dispersed, and their successors only agreed to redeem 10 copies of the title. “My garage was filled with 19,990 Slow Death Funnies 1 and I had to find a way to get rid of them”, he laughs.

This task proved easier than one might initially presume: with his good-humored nature, Turner unloaded his goods at 200 locations, not just head shops but also universities, hairdressers and even a leather jacket store. Eventually,Last Gasp reprinted the comic and sold around 45,000 copies. After this initiation, the socially-aware Turner satyed in the business because “it was a kooky way to shed some light on issues that needed attention.”

Last Gasp’s second publication was the all-woman feminist first It Ain’t Me Babe. “At the time, I was living alone with my newly-born daughter and I was drawing comics,” says Trina Robbins, who put together the title. “But you wouldn’t know it, because the 98% male underground comix industry had shut me out. I heard that Ron was looking for material for a women’s liberation comic book. I phoned him. The next day he visited me, wrote me a check for $1,000 — which in those days was quite an amount of money — and voilà!”

The 1975 book Amputee Love probed another rarely addressed topic, the sexual life of a crippled couple. “UC medical centers purchased some copies to sensitize nurses to the fact that amputation does not mean death of sexuality,” says Ron Turner. Other notable contributions to unconventional subject matters include Anarchy (1978) and Cocaine Comix (1976).

According to Ron Turner, cartoonists hold the highest rank in creativity because they can communicate their vision the most clearly: “Most art is some form of propaganda. The artist wants to sell you on his vision and what it leads to.” Turner’s fascination with human behavior conditioning stems from his psychology studies.

At 70, Ron Turner still sports a hippie hairstyle: a white hair ponytail and an eccentric plaited beard running down to the navel of his buddha-like belly. Comix aficionados regard him not only as a pillar but also as a guardian angel. “Last Gasp is unique in that it’s a publishing house and also a distributor. It has kept many smaller and larger presses afloat,” explains Cartoon Art Museum curator Andrew Farago.

Niched in a corner room of Last Gasp’s Florida Street offices, Turner’s personal collection of popular art is an eclectic mix of original drawings and paintings, side show banners, circus items and vinyl sculptures. “Are these for real?”, hollers a guy named Charlie, who is lending a hand in preparing the anniversary art show. He has uncovered a pile of four framed paintings that serial killer John Wayne Gacy made while on death row. Lowbrow art is definitely not for the fainthearted.

Director Susi Damilano continues the streak with SF Playhouse’s latest, the less heavy but very funny Den of Thieves, about an unlikely foursome of inept bandits caught trying to heist a Mafioso’s safe under a discotheque in Queens — a simple tale that gives plenty of scope to Guirgis’s muscular way with dialogue and the clash of characters. It’s a meaty comedy, and the exceptional cast sells the conceit so beautifully they make it a crime to miss. (Avila)

The flight is occasion for Frannie’s own flights of memory, exotic behavior in the aisle, and unabashed advances toward the flight deck brought on by the seductively confident strains of the captain’s commentary. Davenport) has eaten her way into a wheelchair on the front porch, where she keeps a collection of bugs she occasionally likes to smoosh and have buried in the yard by her doting younger brother Moses (Michael Phillis). In contrast to Sisser’s morbid streak (and it only gets worse), Moses Bean is a good guy, very much the exception to the cursed Bean household sitting ramshackle at the edge of the mud. Annabelle (Kendra Owens), last in an ancient line of African American "sugar witches," recounts how Moses was, like his namesake, snatched as a baby from a floating basket, impressing their already smitten guest, local undertaker and Moses’s love interest Hank (William Giammona). But when a rudely aggressive female suitor (Amelia Mulkey) with a mean grandpappy (Jay Smith) offends Sisser, that old Bean curse gets a new coat of red paint, putting happy endings in jeopardy. With The Sugar Witch, playwright Nathan Sanders continues the gothic saga he began Off-Broadway with first play The Sugar Bean Sisters, set in an imaginary Florida swamp town not far from Disney World. But if Sugar Bean is something of a low-rent magic kingdom, complete with flying cats and occult spells, here the history of racism and patriarchal tyranny tends to resurface like so many bodies imperfectly weighted down and fed to the swamp. That history/mystery adds a stark, potent dimension to an otherwise fitfully effective, somewhat sentimental dark comedy, gamely acted all around under Dennis Lickteig’s thoughtful direction. any array of deliberately posed models and idealized landscapes can attest. Naomi Iizuka’s Concerning Strange Devices for the Distant West offers an intriguing glimpse behind the photographic façade from both sides of the lens. Using the medium of photography as its unifying thread, Strange Devices ties together two moments in time — the 19th century and the present — as a collector of rare Meiji-era photographs (Bruce McKenzie) comes to modern Yokohama to make a buy, eager to believe in the constructed reality their images represent. But as the tantalizing fragments of a mystery of birthright unfold within an elaborate web of forgery, fraud, and blackmail, so does the realization that, even posed, the truth of a photograph lies within the moment of time it captures, even when misinterpreted by the viewer. A spare set of sliding panels designed by Mimi Lien suggests both the interior of a camera and the secret sliding compartments of a Japanese puzzle box, and the intricate, interlocking tattoo art designed by costumer Annie Smart dazzles, as does the "camera-flash" lighting by Alexander V. A fiery young man (Liam Callister) stages a beachfront play starring his equally ardent first love (Kelsey Venter) for the benefit of the familiar flock of seasonal neighbors out on Long Island — and the professional and spiritual punishment of his commercially successful and completely self-absorbed actress-mother (Trish Mulholland). Youthfully high-spirited and talented, the world (especially out here) might have proved his oyster, but things soon fall apart, disintegrating and melding again on the shoreline (handsomely evoked in Robert Broadfoot’s scenic design) as if he and the other nine characters in this shrewd, droll and melancholic play were so many sand castles. Emily Mann’s free adaptation of Chekhov’s Seagull captures the essence of his early "comedy" — very much a human comedy, brimming with pain, turmoil and tragedy in equal measure with laughter, love and folly — and yet manages to be completely of its own (our own) time and place, so effortlessly as to seem a little miraculous. It helps, naturally, that director Reid Davis has assembled a very solid and enjoyable ensemble cast for this wonderfully tailored Shotgun Players production. The opening play-within-a-play is apt several times over, but not least because this is a satisfying night of theater for anyone who loves theater, and anyone else who still doesn’t know it yet. Study: Cuts to health programs a bad plan for state economy

It doesn’t take a Ph.D. to understand that people who earn less shell out a greater percentage of their income from month to month than those occupying more elite ranks. Anyone fortunate enough to be holding down even a low-paying gig in a state where unemployment stands at 12.5 percent knows that basic living expenses can quickly consume a paycheck in San Francisco.

A study released by the Center for Labor and Research Education at the University of California at Berkeley has found that cutting relatively low-paying jobs in the state’s health and human services sector would deal a harsher blow to California’s financial health than alternative budget-balancing measures, like raising taxes on the wealthiest residents. Gov. Arnold Schwarzenegger has proposed cutting $6.4 billion from California’s health and human services budget, part of his solution for closing a roughly $20 billion budget gap.

“The budget proposals that the governor is making would … significantly worsen the economic crisis in the state, rather than pull us out,” said Ken Jacobs, chair of the Labor Center at UC Berkeley.

The report highlights “multiplier” effects of hypothetical cuts to statewide health and human services programs. The study examined the impacts of cutting $1 billion each from Medi-Cal, Healthy Families, and CalWORKS – state programs that assist low-income families – and found that the resulting losses would total 98,600 jobs for all three combined. The worst impacts from cuts to those programs would come from indirect consequences, according to Jacobs. Since those programs are funded in part from federal dollars, a loss in federal funding matched for every dollar the state invests also takes a toll.

A $1 billion cut to state funding for In-Home Supportive Services (IHSS), which aids disabled and elderly people who want to remain in their homes, would result in a statewide loss of 215,900 jobs, the report found.

Meanwhile, generating that same $1 billion through taxes from households in the highest income bracket in California would result in a comparatively lower job loss of 6,400, the research group estimated.

Health Access, a nonprofit consumer advocacy group, used the study’s findings in its own report to predict ramifications of the actual proposals in Schwarzenegger’s budget. According to Health Access, a minimum of 42,384 jobs would be lost as a result of proposed health cuts to Healthy Families and Medi-Cal, with more than $2.7 billion lost in business activity. It predicted 370,000 jobs would be wiped out if IHSS were eliminated altogether.

In a tumultuous economic downturn like the one facing California right now, “the best stimulus is funds in the pockets of low-income families,” according to Jacobs. Cutting these health and human service programs, which employ low-income workers and serve residents living near the poverty line, would do just the opposite.

Speaking of multipliers, Jacobs noted that corporate tax cuts produce the absolute worst bang for the buck out of any other schemes to fix the economy.

Obama nominates Melinda Haag

President Obama has nominated veteran attorney Melinda Haag to serve as the U.S. Attorney for the Northern District of California, which stretches from the Monterey Coast to California’s northern border with Oregon and from the Pacific Ocean nearly to Sacramento, an area that more than 7.3 million people call home. Obama also nominated Jerry E. Martin as U.S Attorney for the Middle District of Tennessee, and James A. Lewis as U.S. Attorney for Central District of Illinois.

“I am so pleased the President has nominated veteran attorney Melinda Haag to serve as the top federal prosecutor in San Francisco,” said U.S. Sen. Barbara Boxer, who recommended Haag for the post. “She is well respected in the California legal community and will bring more than two decades of experience handling white collar crime cases to the U.S. Attorney’s Office.”

Boxer likely isn’t the only one pleased by this nomination: San Francisco’s embattled immigrant community has been hoping that Obama would replace the current top federal prosecutor Joseph Russoniello, an ardent opponent of sanctuary legislation.

According to a press release issued by Boxer’s office, Haag has been a partner since 2003 at San Francisco-based Orrick, Herrington & Sutcliffe in the white collar criminal defense and corporate investigations group, which handles cases involving fraud, antitrust violations, environmental crimes, health care fraud and other corporate matters. 

Before that, former U.S. Attorney and current FBI Director Robert Mueller recruited Haag to serve in the San Francisco U.S. Attorney’s Office, where she headed the White Collar Crime Unit and was the deputy chief of the General Crimes Unit. Haag also has experience as a prosecutor in the Los Angeles U.S. Attorney’s Office.

Haag received her bachelor’s degree from the University of California San Diego and she earned her law degree at UC Berkeley.

Can Newsom save SF parties?

Why won’t Mayor Gavin Newsom save San Francisco’s nightlife and culture? That question was raised toward the end of this week’s cover story on party-crashing cops, but it’s worth highlighting here because Newsom seem uniquely suited to the task of mediating this damaging dispute.

Newsom owned a restaurant and bar before being elected mayor with the strong support of the San Francisco Police Officers Association. The business community is one of his key constituencies, and he constantly talking about the need to promote tourism, which relies on our cultural vitality. He’s the most natural, logical bridge for this divide.

That’s why attorney Mark Webb, who represents several clubs and individuals who have been harassed by SFPD Officer Larry Bertrand, has explicitly been calling for Newsom to get involved.

“I really believe his involvement could help us get to a place of calm,” Webb said. “We have to stop this petty infighting and we have to embrace the cause, which is to make San Francisco’s nightlife an inviting environment.”

DNA Lounge, which is not part of Webb’s lawsuit but has been fighting against harassment by Bertrand and the ABC, also wants to see Newsom broker some peace talks. 

“Absolutely, Gavin certainly has the juice to deal with this problem and we would welcome his involvement,” DNA general manager Barry Synoground told us. “We don’t know why there is such vehemence against nightlife and entertainment…What kills me is we have a large group of responsible purveyors, but we’re not being treated as such. We’re being treated like criminals.”

But Newsom has resisted the call, with his press secretary Tony Winnicker telling us, “I wouldn’t rule it out, but the mayor has department heads for that reason,” saying he preferred for Police Chief George Gascon to tell with it. But the problem is this isn’t a police issue, it’s a political one.

DNA Lounge (which has reguarly blogged the crackdown) has highlighted how SFPD Commander James Dudley sees nightlife in the city: as a nuisance to be abated, rather than an important culture to be embraced and celebrated. Winnicker claims that Newsom understands this: “The mayor understands the importance of a vibrant nightlife.”

But that understanding hasn’t translated into official city policy. Attorney Mark Rennie, who handles permitting and compliance issues for about 40 nightlife and culture clients, said that San Francisco has become notorious for making life difficult for club owners and other purveyors of fun. 

“The city has always had this love-hate relationship with nightclubs. But it’s really bad now,” Rennie said, noting how welcoming other local cities are toward nightclubs, which are important economic drivers. “Berkeley gets it. Oakland gets it. I don’t know why San Francisco doesn’t get it.”

Which is strange because, of all people, Newsom should get it. He should understand the natural tension between certain elements of both the police and nightlife communities and, valuing them both, try to find a way to solve this problem. So whatdaya say, Gavin? After you’re done try to clean up the mess you created with the labor unions, how about stepping in to address a problem that is closer to your sweet spot?

Sure, there are lots of drums and rhythmic bass, and the squealing vocals of Daniel Martin-McCormick are one-of-a-kind, but Mi Ami’s songs are longer, more about repetition and atmosphere. Ana Tijoux

As one of Chile’s most respected lady MCs, Ana Tijoux is different from the summery South American songstresses who often breeze through town. Born into exile, Tijoux began life in France, where her Chilean father and French mother fled during Pinochet’s cruel regime. As a teenager, she returned to her father’s homeland and quickly found a home in Santiago’s burgeoning hip-hop scene. It was there that she earned her cred as a conscious “rapera.” Her upcoming solo release 1977 (Nacional Records) drops lyrics that reflect on the year of her birth, and that unique moment in Chile’s turbulent history that heavily influenced her own. FILM The tagline “in glorious Technicolor” was never done more justice than when cinematographer Jack Cardiff was behind the camera. Whether summoning vertiginous Himalayan vistas, making a pair of scarlet ballet shoes outshine Dorothy’s ruby slippers, or accentuating a female star’s sensuality while also capturing her intelligence, Cardiff’s mastery of light and his bold, at times hallucinatory, use of super-saturated color put him in a class above in a field already filled with so many greats.

The Pacific Film Archive pays tribute to Cardiff starting this week, in a modest five-film retrospective, “Life, Death, and Technicolor,” that kicks off with the three films he shot for fellow Brit Michael Powell — A Matter Of Life and Death (1946), Black Narcissus (1947), and The Red Shoes (1948) — that represent the pinnacle of his talents. Certainly, the series’ other two films, Pandora and the Flying Dutchman (1951) and The Barefoot Contessa (1954), have their charms (namely, Ava Gardner). But in a long and distinguished career that started in the silent era and included stints with Huston, Hitchcock, and Welles, as well as lensing some of the screen’s great female beauties, Cardiff’s work with Powell and his partner Emeric Pressburger remains unsurpassed.

Like the art historical precedents he cited as influences — apparently, his knowledgeable explanations of Caravaggio and Vermeer’s technique landed him the job with Technicolor — Cardiff understood the affective power of color and used his palette to ratchet up the emotional intensity of Powell and Pressburger’s lush melodramas to new extremes. The red lipstick that Kathleen Byron’s near-hysteric Sister Ruth applies before Deborah Kerr’s shocked Sister Clodagh in Black Narcissus; the marine blue of the fairy tale gown Moira Shearer’s dancer wears to meet the ballet impresario in The Red Shoes; and the sudden floods of color in A Matter of Life and Death during its periodic switchovers from black and white stock.

And yet Cardiff’s technical achievements extend far beyond his eye for hue. All the Pandoran CGI eye-candy generated by James Cameron’s digital production army dulls in comparison to the kaleidoscopic Himalayan countryside, with its snow-capped crags and verdant foliage, that Cardiff conjured up entirely within a London studio for Black Narcissus. Likewise, the ballet-within-the-film sequence in The Red Shoes, which takes us beyond the theater proscenium into a gorgeous and melancholy land of a thousand dances, stands alone as one of the single-most gorgeous 20 minutes ever committed to film (as those who recently caught a restored print of the film at the Castro Theatre can attest to).

Indeed, the superlatives come easy with Cardiff. If you go to one of these films, you’ll see why. Your senses will thank you.

The Haight-Ashbury is out-of-control, according to some recent news reports and testimony by cops and other backers of the proposed sit-lie ordinance. They report street toughs brazenly smoking crack, blocking sidewalks, spitting on babies, and intimidating citizens with pit bulls.

As this story goes, dangerous thugs have replaced harmless beggars. They’ve gone from annoying to menacing, a change police say they’re helpless to address without legislation banning sitting or lying on sidewalks, which Mayor Gavin Newsom and Police Chief George Gascón introduced March 1.

Proponents and opponents have attended City Hall meetings and voiced their arguments in the media. The police, homeless rights advocates, Haight Street business owners, residents, Newsom, and columnists have spoken their piece. But what do the street kids, who haven’t been heard from in this debate, have to say for themselves?

So on March 19, I spent the day walking the Haight to get the perspective from the street, asking kids what they think is going on?

It’s 3 p.m. and I’m standing on the southwest corner of Central and Haight streets next to a Bob Marley mural painted on the side of a liquor store. A cop car cruises by. With no thugs or panhandlers in sight, I head toward Golden Gate Park along the south side of the street.

On the corner of Masonic and Haight, there are some well-kept teens perched against the wall of X-Generation. Clutching shopping bags, they are not panhandlers, but they sit on the ground because Haight Street doesn’t have benches, except for one on Stanyan facing the park.

These kids clearly aren’t the targets of this ordinance, so I move on to the notorious Haight-Asbury intersection, which is also devoid of vagabonds. An old woman and young boy, both well-dressed, squat in front of Haight Asbury Vintage, watching shoppers pass by.

Almost at the end of the block, outside a closed storefront, a scruffy young man is perched on a back pack holding a battered piece of cardboard that reads “SMILES/HAVE A NICE DAY!? OR NIGHT.”

“You have a beautiful smile,” he croons to passersby. Most stare straight ahead, some smile without making eye contact; a woman in her 30s asks to take his picture. Jay is 18, has a scarce beard and crust in the corners of his sleepy pale blue eyes. He is from Ohio and says he has been bumming on Haight and sleeping in the park for about three months. He hitchhiked to San Francisco because his sister is “a back-stabbing crack head, so I left.”

He doesn’t think panhandling has become more aggressive recently, but that business owners “just want to be asses.” He’s not much of a talker and more interested in smiles, so I leave Jay to his work.

On the next block I meet Kevin Geoppo, 31, cupping a handful of coinage, sitting on the window ledge of a storefront under renovation. Kevin says he’s a heroin addict who grew up in Orlando, Fla., and made his way to San Francisco years ago. He’s obtained an SRO and primary care doctor, but can’t get a job.

He sees both sides of the sit/lie law debate. “Those who sit and lie do cause a lot trouble, stir up energy that isn’t needed to [hurt] tourism, and [threaten] violence, so I can understand why this is being talked about,” he says.

At the same time, he is wary of how the police would use the law and at whom it would be directed. He doesn’t think things are getting worse, but he says the panhandling and menacing attitudes of some kids ebb and flow as different groups pass through the city.

“A lot of these yuppie, rich, bureaucrat people are trying to clean up everything because if you take a left or a right anywhere off Haight Street, it’s rich people living in those houses,” he says. I let him get back to business and proceed down the street.

I decide to drop into Aub Zam Zam cocktail lounge for a veteran bartender’s opinion. Owner Bob Harpe is behind the horseshoe bar, slicing limes and chatting with long-time Haight resident Paul Zmudzinski.

Harpe doesn’t have problems with aggressive or congregating street kids. “If you ask them to move and treat them with a general level of respect, they go on their way.”

He believes the rising number of homeowners in the neighborhood and businesses catering to a more affluent clientele are behind the recent uproar. “The rents on Haight Street have escalated dramatically, so boutique owners have to pump up their prices. Then you get more affluent shoppers who are turned off by the skuzzy-looking street kids coming through,” Harpe says. “The whole thing is kind of disgusting.”

Back outside, I head to the next block and come across Kasper who is “flying a sign” that reads “SEX!!! NOW THAT I HAVE YOUR ATTENTION, SPARE ANY $$$?”

He is a 33-year-old traveler who just landed back on Haight, having spent the last three weeks in Berkeley. He’s headed north to a 420 Rainbow gathering and then to Idaho for work. With combat boots, Army pants, and a neck tattoo, he’s a tough-looking guy with a soft-spoken voice.

“They don’t understand all the money they’ll lose. We panhandle money in the street and then spend it in the stores here,” Kasper says. “Those liquor stores rely on street people.”

He says many tourists come to the Haight to see people playing guitars, banging drums, and selling their hemp trinkets. And when it comes to instances of violence or aggressiveness, those are limited to a few of the community and could happen anywhere, regardless of a sit-lie law.

“These things are heavy,” he says nodding to his backpack. “To have to stand, hold your straps, and fly a sign to get something to eat is just ridiculous.”

McDonalds is the last establishment before Golden Gate Park, which serves as a three-mile squatter haven stretching to the Pacific Ocean. Beneath the golden arches, three guys are singing an improvised McDonalds song, but two busted guitar strings kills their burger ballad hustle.

The three agree to an interview and form a semicircle on the sidewalk. Stoney, 19, the guitar player, is wearing sunglasses, a backwards cap, and is heavily scarred on his arms and neck. “Are you against weed?” he asks, before hitting a pipe carved from a deer antler.

Angelo, 23, is a self-dubbed vagabond originally from Virginia. He just got out of jail for selling weed to a cop in the Tenderloin. Nick, 18, wears a mighty Afro and says almost nothing.

Two bike cops zip up and tell us to move it. “You’re blocking the sidewalk,” one cop says. Everyone stands up. “It’s not illegal yet, dude!” Stoney yells back toward the cops as we cross Stanyan to enter the park.

Stoney and Angelo agree with each other that lawmakers are focusing on the bad actions of a few to push all street kids off Haight. “We have the right to use the sidewalk just like anyone else,” Angelo says. “It’s crazy, man. We’re all just fuckin’ a bunch of cells put together, floating around a ball of fire in space.”

The new War on Fun

For several years, the Guardian has been running regular stories chronicling what we’ve dubbed the Death of Fun, a trend of official crackdowns and shakedowns on people who throw parties and festivals in San Francisco. In the last year, that trend has started to morph into an often brutal War on Fun, with a growing list of atrocities and casualties associated with this overzealous new approach to killing the city’s entertainment industry.

Why this is happening is baffling to those most affected: nightclub owners and workers, party promoters, DJs and VJs, fundraising activists, and people just out to have a good time without being harassed by a cop. But in recent months, we’ve learned much more about what’s happening and who the main perpetrators are.

Two undercover enforcers have been at the center of just about every recent case of nightclubs or private parties being raided without warrants and aggressively shut down, their patrons roughed up (see “Fun under siege,” 4/21/09) and their money, booze, and equipment punitively seized “as evidence” (see “Police seize DJs laptops,” 11/24/09) even though few of these raids result in charges being filed in court.

Officer Larry Bertrand of the San Francisco Police Department’s Southern Station and Michelle Ott, an agent with the California Department of Alcoholic Beverage Control, are plainclothes partners who spend their weekends undercover, crashing parties, harassing disfavored nightclubs, brutalizing party-goers, and trying to send the unmistakable message that they’re in charge of San Francisco nightlife. Neither responded to our interview requests.

Isolated incidents of intolerant cops and NIMBY citizens who repeatedly complain about certain clubs or festivals has been a problem for years (see “Death of fun,” 5/24/06 and “Death of fun, the sequel,” 4/24/07). Top city officials have opted to cancel events such as Halloween in the Castro District rather than try to manage them better, and the nightlife community has tried to organize in defense of its interests (see “Fighting for the right to party,” 7/1/08) with mixed results.

But the personal War of Fun by Bertrand and Ott seems to have galvanized and united the nightlife and festival community like never before, leading to the creation of a new California Music and Culture Association and prompting threats of a federal lawsuit alleging the ABC-SFPD collaboration is a racketeering scheme designed to harass, disrupt, and extort people engaged in otherwise lawful activity.

The myriad horror stories associated with Bertrand and Ott have also finally begun to draw attention from the Mayor’s Office, which has quietly pushed the SFPD to rein in Bertrand and change its policies on raiding parties and seizing property. State Sen. Mark Leno also has gotten involved, brokering a March 12 meeting between club owners and Steve Hardy, director of ABC (which, in addition to cracking down on nightclubs — see “Busting bars,” 6/23/09 — has recently announced a campaign against fruit-infused liquor).

“They were going to see how they could unwind this a bit,” Leno told us, adding that he was “infuriated” by stories of abusive treatment of the public. “The fear that it spreads through the community is unacceptable.”

The question now is what Hardy, Mayor Gavin Newsom, and Police Chief George Gascón — who has ordered some crackdowns and wants greater authority to discipline problem officers — is going to do about it.

 

CHAOS AT A STUDENT PARTY

It was after midnight on Jan. 31 when Krystal Peak, a journalist with San Francisco State University’s Golden Gate Xpress, received a call from her managing editor. There was a commotion and a swarm of police cars outside a student party at Seventh and Minna streets near her home, and she was asked to investigate.

She came upon the aftermath of a melee between police and partygoers that had taken place after a fundraising event at a SoMa warehouse art space was upended. The benefit was organized to raise legal funds for students who staged a building occupation at the University of California at Berkeley, in defiance of budget cuts.

The event was clearly chaotic, and it’s hard to sort out exactly what happened and when. City officials say the partiers were throwing bottles and firecrackers at the police; people at the event say the cops started it all.

But the tales partygoers tell about the behavior of Bertrand and Ott, the undercover enforcers, are similar to a series of other stories involving the pair, stories published in the Guardian and elsewhere.

There had been multiple arrests by the time Peak arrived on the scene. Numerous witnesses asserted that things were going along without incident until a fire marshal arrived in response to a complaint, and in short order, two officers who’d been there in plainclothes for hours — Bertrand and Ott — began shouting, tackling people, and kicking in doors.

Police Chief George Gascón acknowledged that the department has been targeting underground parties. “We get a lot of resident complaints about it,” he said in a recent Guardian interview. “We’re talking about a lot of the underground parties, or the parties where the promoters are exceeding their authorities to a number of people.”

Several hundred attended this particular party. Of the 11 people arrested, eight were either detained or cited and released. None faced underage drinking or drug charges. At least five were charged with resisting arrest. One individual was charged with vandalism, two were charged with battery on an officer, and two detained for being drunk in public.

Peak began photographing the scene: busted-up chairs, uniformed officers guarding the entrance, police cars everywhere. She zoomed her lens to capture the wreckage inside. None of the uniformed officers seemed to have a problem with her — but when she spotted the undercover officers with exposed badges, that changed.

The cops broke through the door, yelling. “They said, ‘This is an investigation, you’re not allowed to be here.'<0x2009> she said. “We told them we were with the press.” They threatened to arrest her.

Shortly after, the plainclothes officers crossed in front of her to an unmarked car. She took another picture. Bertrand, a tall guy with a shaved head, allegedly turned and grabbed her arm, and both officers shouted at her. “[Ott] said to me, ‘Your flash has impeded my investigation,'” Peak recounted. She was cuffed and arrested on the spot, and her camera was confiscated.

She was cited for obstruction of justice, but the charges were dropped. And she got her camera back — but says the SD memory card, where all the photos were stored — was missing.

“I flipped [the camera] open … and found the SD card was missing,” she said. She asked Bertrand where it was. “He said, ‘I don’t know what you’re talking about,'” Peak recalled. Bertrand, she recalled, then looked around at a group of officers watching the exchange, and announced, “This woman is refusing to leave. I’m going to have to re-arrest her.” Ott appeared, according to Peak, and insisted that there was no evidence the memory card had been in the camera in the first place.

“My camera will not ignite a flash unless there’s a memory card in there,” Peak explained. In the end, she left empty-handed — without photos of the undercover officers.

 

BUSTING DOORS

Earlier, when the party was in full swing, a 24-year-old California State University, Fullerton student visiting from Los Angeles says when the fire marshal entered, Bertrand flashed his badge, yelling at everybody to get out. “It was really aggressive from the get-go,” said the Fullerton student, who spoke on condition of anonymity because he had a pending legal case. “It’s very hard for me to describe the intensity to which this guy was busting down doors.”

Later, the young man from L.A. said, he was following people who left in a rush, and ran to catch up. “Shortly after, I felt a blow to the back right of my head,” he said. “My glasses flew off, and I was tackled to the ground. My forehead was being pushed straight into the ground and they were holding my hair. I kept repeating … please, I can’t see — I’m legally blind. I thought three or four officers were on top of me, and they were saying, ‘Fuck you, you little anarchist punk.'<0x2009>”

That’s when he said he felt a sensation like “a bunch of really intense bee stings on my left side, just above my hipbone.” He thought he was Tasered — and photos he showed us depict a skin burn. SFPD officers are not authorized to carry Tasers.

“It sounds like a stun gun, not a Taser gun,” Ken Cooper, a firearms and Taser instructor based in New York, noted when the incident was described to him.

When we shared the photos with SFPD’s media relations department, Lt. Lyn Tomioka noted, “I can tell you that we do not have any tool that would produce the type of wounds shown in the picture that you attached, or produce a stinging sensation.”

The L.A. visitor said he was delivered this explanation from an officer while in the holding cell: “One of your anarchist buddies must’ve had a Taser, ran over to you trying to get one of our officers, got you instead, and ran away.”

Cooper Brislain, a Web developer from Santa Cruz, told us his iMac was destroyed that night. A friend of the owners of the art space, he was there doing video mixing for the party, he explained. After the trouble started, he began carrying his computer and mixing equipment toward the door. “The uniformed officers were going to let me go. I told them, ‘I just came here to perform.’ They seemed OK,” he said. Then he encountered Bertrand.

He … grabbed me by the collar, led me over toward the wall, and sat me down,” Brislain told us. He says Bertrand and Ott seized his computer. Brislain says no charges were filed against him.

The morning after, he found that his computer had been smashed up. His friends found it in pieces at the bottom of the stairs. To this day, he says he has not been able to retrieve his ID, which was seized that night. “I tried calling [Bertrand] on his extension to leave a message and never heard back,” he says. “They told me he probably wouldn’t return voicemails.” The District Attorney’s Office has a different perspective. D.A. spokesperson Brian Buckelew said the partygoers were drunk and “going nuts on police.” People were throwing firecrackers, he said. “It obviously got out of hand, and people were throwing bottles at police,” he said.

The student from L.A. allegedly shoved a female officer, Buckelew said. According to the report, he said, police officers were taking someone into custody, and he tried to pull them free.

Nevertheless, even Chief Gascón agrees that it’s not okay to destroy someone’s personal property. “If in fact the allegations were proven to be the case that an officer took somebody’s laptop and threw it down the stairs,” Gascón told us, “that would be inappropriate, and that officer would be sanctioned accordingly.” He noted that he met with an attorney from the Electronic Frontier Foundation about a recurring trend of officers — Bertrand in particular — seizing DJ laptops at underground parties. “We’ve met with them and we’ve agreed to actually tighten up the protocols in how this would be handled,” Gascón noted.

 

A RICO SUIT

The list of local nightclub clubs that have been recently targeted by Bertrand and Ott or subjected to ABC sanctions is long. It includes Great American Music Hall, Slim’s, DNA Lounge, Mist, Whisper, the Room, Vessel, Azul, Butter, and Club Caliente (which closed down after its mostly Latino customers were scared away by repeated raids).

“Using the now familiar pattern and ruse of ABC authority, these raids have been without warrant and without probable cause, under the pretext of finding liquor violations,” attorney Mark Webb wrote in a claim against the city, describing the harassment of Caliente owner Maurice Salinas and later adding, “Despite numerous raids, the invading officers [Bertrand and Ott] managed to ‘uncover’ a single infraction: one customer used his brother’s ID card, claiming he was over 21 to gain entry. For this reason, Mr. Salinas was cited and fined, bullied, intimidated, and yelled at on the spot.”

Webb said such behavior isn’t legitimate police work, but unlawful harassment. In fact, this experienced litigator said it’s far closer to the shakedowns and extortion rackets familiar to him from the start of his legal career in the late 1970s prosecuting organized crime cases in New York City.

That’s why he’s threatening to bring a novel lawsuit against the city and ABC under federal Racketeer Influenced and Corrupt Organization (RICO) Act, a law designed go after the mob, but which has since been adapted to target entities ranging from the tobacco industry to the Los Angeles Police Department.

Webb told us that interference with legitimate business operations, such as running a nightclub, is the essence of RICO suits. As part of the case, Webb plans to submit a surveillance video that shows Bertrand kneeling on the neck of bartender Javier Magallon from The Room and twisting his arm. Webb gave us a copy of the video.

Another element of making a RICO case is the use of intimidation and retaliation against those who complain — which was central to a March 17 SF Weekly story about promoter Arash Ghanadan being inappropriately singled out for arrest by Bertrand as retaliation for filing a complaint against the officer with the Office of Citizen Complaints.

Webb says he has a strong case that he intends to file soon, but that most of his clients just want the SFPD to rein in Bertrand and stop facilitating ABC actions. “I want to have a sit-down with Gavin Newsom,” Webb said. “I am calling on Mayor Newsom to come in and mediate what would be an expensive, divisive fight that will generate national interest … I think this thing can go way quickly without litigation.”

Newsom press secretary Tony Winnicker, who said Newsom has brought concerns about Bertrand to the chief’s attention, didn’t immediately embrace Webb’s offer. “The mayor would rather leave it to the chief,” Winnicker said.

So the question for Gascón is whether he’s willing to take on the cowboy cops within the SFPD’s ranks. After all, Bertrand is also on the San Francisco Police Officers Association Board of Directors.

The nightlife community is organized like never before and plotting its next move in fighting a war it didn’t initiate and barely understands. Whether that war continues now seems to be a question for the party crashers and their supervisors.

Poll: 73 percent in favor of simple majority vote for budget legislation

A new poll by David Binder of DB-Research, conducted on behalf of Californians For Democracy, shows that 73 percent of California voters support a simple majority vote for revenue and budget legislation. Voters were asked to weigh this proposal: “All legislation on revenue and budget must be determined by a majority vote. Would you vote for it?” In response, 73 percent said yes, and 22 percent said no.

The findings are being hailed as a ringing endorsement for the California Democracy Act, a November 2010 ballot initiative authored by UC Berkeley Professor George Lakoff that would change the California Constitution from requiring a two-thirds vote of the Legislature to approve budget and tax proposals to a simple majority rule. Californians for Democracy is in the process of gathering signatures for the initiative.

800 respondents were questioned for the poll. When respondents were asked, “In a democracy, a majority of legislators should be able to pass everyday legislation,” 71 percent said yes, they agreed. When asked, “In a democracy, a minority of legislators should be able to block everyday legislation,” 68 percent said no, they disagreed. Tax worries were addressed as well – 62 percent of respondents agreed they would support a proposal “solving the budget crisis by closing tax loopholes on corporations and charging oil companies an extraction fee without raising taxes on the lower and middle income Californians.”

Since a large amount of state legislation is required to be part of the budget, the initiative could have a far-reaching impact. Californians For Democracy has stated that a 37 percent minority blocks a 63 percent majority on everyday legislation.

“We made sure to ask the right-wing questions and our questions,” Lakoff told the Guardian, noting that most polls only present one side. “Republican questions get Republican answers,” he said. “We finally asked the question on both sides, and the answer is clear.”

Amid the tumult of the American Civil War, a former slave named Damascus (a subtle, commanding Aldo Billingslea) searches for his daughter, desperate to pass on his song to her lest it be forgotten. Plucked from a tree and a noose by a god moved to see him get a second chance, he searches on, now as a woman named Demeter, until he finds a white family called the Verses, served by a downhome Shakespearean schemer named Brer Bit (Martin F. Grizzell, Jr.) and headed by a bitter matriarch (Jeanette Harrison) in the absence of the paterfamilias (David Sinaiko), a deserter-turned-scavenger making his way back with a Yankee bugler (Zac Schuman) in tow. Twin daughters Blanche (Sarah Mitchell) and Free (Erika A. McCrary), meanwhile, are not so very identical, and Demeter suspects that Free — whose imaginary friend is an African American Jesus with a decidedly 20th-centruy mojo (played by a beautifully deadpan-beatific David Westley Skillman) — is actually his/her own kin. In this inspired poetical-historical counter-narrative from Bay Area playwright Marcus Gardley, Greek mythology, African American folklore, personal family history, and Christian theology are all drawn irresistibly along in a great sweep of wild and incisive humor, passion, pathos and rousing gospel music as buoyant and wide as the Mississippi — or rather Miss Sippi (the impressive Nicole C. Julien), personification of the mighty and flighty river, backed by a chorus of blue-gowned sisters (Rebecca Frank, Halili Knox, Erica Richardson). The Cutting Ball–Playwrights Foundation coproduction, lovingly directed by Amy Mueller, sports exquisite design touches from Cutting Ball regulars like Michael Locher, whose gorgeous plank-wood set serves as the ideal platform for a work both magnificently simple and eloquently evocative. The company already scored big with two of the New Yorker’s gritty, dark and sharply funny plays, Our Lady of 121st Street and Jesus Hopped the ‘A’ Train. Director Susi Damilano continues the streak with SF Playhouse’s latest, the less heavy but very funny Den of Thieves, about an unlikely foursome of inept bandits caught trying to heist a Mafioso’s safe under a discotheque in Queens — a simple tale that gives plenty of scope to Guirgis’s muscular way with dialogue and the clash of characters. The story opens on a depressed recovering kleptomaniac, Maggie (an affectingly understated Kathryn Tkel), and her 12-step sponsor Paul (the excellent Casey Jackson), a nerdy fast-talking mixed-race former safecracker, whose Jewish grandfather headed up a famous crime ring that robin-hooded their take to library construction for kids in the neighborhood. Enter Maggie’s former boyfriend, a Puerto Rican tough named Flaco (a hilariously spot-on Chad Deverman), with his new squeeze, erotic dancer Boochie (a deftly comic Corinne Proctor), and a lead on a large traceless sum of cash. Suddenly the smell of big money sends recovery out the window and makes uneasy bedfellows of the motley, hostile bunch. Enter angry but softhearted mobster Little Tuna (Ashkon Davaran), his sadistic sidekick Sal (Peter Ruocco), and big gun Big Tuna (Joe Madero). Facing mob vengeance, it’s time for some fast-talking and deal making among the mini-den, and all bets are off. The ending seems to have eluded Guirgis a little, but the way there makes for meaty comedy, while the exceptional cast sells the conceit so beautifully they make it a crime to miss. (Avila)

The flight is occasion for Frannie’s own flights of memory, exotic behavior in the aisle, and unabashed advances toward the flight deck brought on by the seductively confident strains of the captain’s commentary. The singular personality and mother-daughter relationship that unfurls along the way is riotously demented and brilliantly humane. (Avila)

In the wake of March 4, education battles continue

Two weeks after protests against cuts to education filled Bay Area streets (and one freeway) on March 4, employees in the public-education sector are still engaged in a fight against budgetary rollbacks. But it’s an uphill battle, as was made clear at a briefing organized by United Educators of San Francisco at City College of San Francisco March 18.

At El Dorado Elementary School in the Bayview, 11 of 15 teachers were issued pink slips, according to elementary school teacher Megan Caluza (featured in the video above). While this doesn’t mean all 11 teachers are on their way out the door, it does mean that none of them knows for sure whether there’s a guaranteed job in the school district in the coming year. Since the budget cuts hit, Caluza says she’s been spending just as much time “fighting to teach” as she has in the actual classroom.

Elementary schools aren’t the only places being hit hard. Statewide, more than 23,000 layoff notices were sent to K-12 teachers recently, with no one knowing for sure which recipients will stay or face job losses.

“What is more important to you, corporate tax loopholes, or teachers in your daughter’s classroom?” asked Dennis Kelly, president of United Educators of San Francisco. “A college education for your son to get ahead, or tax breaks for the wealthiest Californians?”

Meanwhile, community colleges throughout the state face fee hikes even as classes are being cancelled, summer programs are being scaled back or eliminated altogether, and staff faces layoffs and furloughs. According to AgainstCuts.org, a group that was instrumental in organizing March 4 activities, the student population at California community colleges is comprised of more than 50 percent women and people of color, with around 80 percent of students working while taking classes. Blows to this educational system impedes opportunities for career advancement for the nearly 3 million community college students, which is bad news not just for students with lifelong dreams and high hopes, but California’s economy as a whole.

On Monday, March 22, more than 3,000 students, faculty members and others from City College of San Francisco plan to hold a march and rally in Sacramento to highlight the impact of cuts to community colleges. Around 62 buses will be leaving SF early in the morning to arrive in Sacramento for a 10 a.m. rally on the steps of the State Capitol Building.

Joining students and teachers at CCSF yesterday was a representative from Californians for Democracy, an organization that is pushing a November ballot initiative, authored by University of California Berkeley Professor George Lakoff, that would change the two-thirds majority vote requirement for the state Legislature to pass a budget or raise taxes to a simple majority vote. While the initiative is still circulating petitions to gather signatures, it seems to have found allies in the growing movement against cuts to education.  

March 4 represented “the first time we’ve ever done an all-education action,” Joan Berezin, a faculty member at Berkeley City College for 20 years, told the Guardian. “We’re trying to build the broadest coalition possible.”
