Another BART police tragedy

EDITORIAL The video isn’t the highest quality — it was taken on a cell phone — but it’s pretty simple to figure out what’s happening. A young man named Oscar Grant is lying on the ground on a BART train platform, surrounded by BART cops. His hands are behind him, and the police have him completely under control.

Grant was one of a group of young men who had been removed from the train and arrested after reports of a fight early in the morning on New Year’s Day. The other suspects are handcuffed; Grant is not, but in early footage, he has his hands in the air and appears to be cooperating. Witnesses on the scene say that’s what they saw — a young man doing what the police told him to do.

Then suddenly — shockingly — one of the officers reaches back and pulls his gun. He points the weapon at Grant, and fires, point-blank, from perhaps two feet away. The bullet entered Grant’s back, ricocheted off the concrete, and hit him again, in the chest.

It’s mind-boggling. It appears to violate so many standards of police conduct we don’t even know where to begin. Oakland lawyer John Burris, who is representing the Grant family, puts the first question pretty succinctly: "Why did he take his gun out?"

Let’s go a few steps further. Why did the BART officer, who has been identified only as a two-year veteran of the force, feel he needed to use lethal force on a suspect who was unarmed, was (at worst) guilty of fighting on a train, and was on the ground with two other cops on top of him? Why did the officer fire his gun at close range, with the prospect not only of hitting his colleagues but also of injuring bystanders? Why didn’t any of the other cops tell him to put the gun away? Why is the young father of a four-year old daughter dead?

We’ll add a few more: Why is BART still in full-on public relations-cover-up mode, acting as if the evidence is still unclear? Why is the name of the officer still a secret?

And why — why, as we’ve asked a dozen times over the past 15 years, do the BART police operate with absolutely no civilian oversight?

The structure of the BART police force is a recipe for disaster. BART’s general manager, (who is not an elected official and has no expertise in law enforcement) hires the BART police chief, who then runs a force with some 200 armed officers. There is no police commission, no police review board, not even a committee of the elected BART board designated to handle complaints against and issues with the BART police.

The BART board holds no regular hearings on police activity or conduct. There is no public forum where the chief is held to account. There is no procedure for complaints against BART officers to be heard and adjudicated by anyone except the BART police.

There is, in other words, no civilian oversight or accountability. This is unacceptable.

The killing of Oscar Grant isn’t an isolated case. Back in 1992, a BART cop pulled a shotgun and killed an unarmed man named Jerrold Hall. Hall wasn’t threatening the officer or anyone else. He was walking away. The shotgun pellets hit him in the back of the head. The officer, Fred Crabtree, was never subject to any discipline, and BART tried to cover up the whole thing (see "Lethal force," 12/9/92). In 2001, a BART cop shot an unarmed naked man who was seriously mentally ill (see "Gun crazy," 10/17/01).

The BART Board simply can’t let this continue. The board must immediately create a process for civilian oversight of the BART police, including a civilian monitor to handle complaints. The BART board must establish a permanent police oversight committee that meets regularly to hear public comments and monitor police practices. Every city that BART passes through, starting with San Francisco, should pass a resolution demanding accountability for the BART cops, and the state Legislature (which granted the BART police peace officer status in 1976) should pass a measure mandating that the BART police have civilian oversight proceedings.

We’re sick of this. How many more people have to die before BART gets its act together?

BART Police: Hope for reform?

The shooting of Oscar Grant, which was captured on several videos, may become for the BART police what Rodney King was in LA: An incident so outrageous it sparks public demand for reform.

The BART Board is still largely missing in action here (although Tom Radulovich, who represents San Francisco, says he supports a move for civilian oversight and will push it if he can get a few other votes). But Assembly Member Tom Ammiano told me he’s looking at what the state Legislature can do here, and Sup. David Campos told me he’s going to introduce a resolution calling on BART to create a credible civilian oversight system.

I talked about this on KQED’s Forum this morning, and urged people to call the BART board members and demand action. The problem, frankly, is that a lot of the people on the BART board are lazy — they don’t want to put in the time or do the work necessary to properly monitor the 200 armed officers they send out to patrol the trains. That’s unacceptable, and they need a swift kick in their collective asses. Maybe a push by the state, and all of the cities tha BART passes through, will help.

By the way, BART’s chief spokesman, Linton Johnson, is kind of a problem. He walked off in the middle of the show ths morning, saying someone on his staff had called in sick. And in an interview last night, when he was asked why BART still hasn’t interviewed the officer, he suggested we all look at it “from the officer’s perspecitive.”

Uh, no, Mr. Johnson — you’re management. You have to look at it from the public’s perspective.

Lethal force

The autumn air was crisp and clear in Hayward on the night the kid called Glasstop took a shotgun blast in the back of the head and died for the theft of a $60 radio.

It was just before 8 p.m., on Sunday, Nov. 15. The lights were on in the parking lot outside the Hayward BART station, where a six-car southbound train had arrived a few minutes earlier. About 50 passengers had gotten off, and some were still straggling into cars or waiting around for the next AC Transit bus.

Glasstop, a 19-year-old warehouse worker from Union City whose legal name was Jerrold Cornelius Hall, had ridden the train from Bayfair, one stop north, along with John Henry Owens, a 20-year-old unemployed custodian who lived in Oakland. The two young African American men were standing at the bus stop, not far from the station entrance, when Officer Fred Crabtree pulled into the parking lot in a BART police cruiser.

Crabtree was a white 16-year veteran of the transit police agency and a member of its elite Canine Corps. His partner was a highly trained German shepherd imported from a special obedience school in Germany. The dog trotted at Crabtree’s side as he approached Owens and Hall. The officer carried a loaded 12-gauge pump-action shotgun.

Crabtree was responding to a report of an armed robbery: Halfway between Bayfair and Hayward, a passenger had told the train operator that two black men had taken his Walkman personal stereo. The passenger said one of the robbers had a gun and described what they looked like; the trainman passed on the message, and the BART dispatcher passed it on again. Owens and Hall matched the third-hand description that came over Crabtree’s radio.

Within a matter of minutes, Hall was lying in a pool of his own blood, Owens was in handcuffs, and the parking lot was a mass of sirens and flashing red lights. Hall was pronounced dead shortly after midnight at Eden Hospital; Owens is still in the Alameda County jail. The police never turned up a gun.

And the man who reported the robbery disappeared without leaving his name.

That’s about all BART officials will say about the incident. They’ve clamped on a lid of secrecy that defies most normal local police procedures and violates the California Public Records Act. The San Francisco newspapers have almost entirely ignored the shooting, and there’s been little reaction from the East Bay community.

But an extensive Bay Guardian investigation has turned up a long list of troubling questions about the death of Jerrold Hall – and a long list of serious problems in an agency that has some of the most sweeping police powers in California, and some of the least civilian oversight.

Our investigation, based on a dozen interviews, a review of public records, and more than 50 pages of unreleased internal documents from the BART police and other local authorities, shows:

Officer Crabtree violated one of the most basic rules of modern law enforcement – and his own department’s written policy – when he fired a warning shot toward the suspect, potentially endangering the lives of passersby in the busy urban area. The nine .33-caliber pellets from that shotgun cartridge wound up in the side of a tree, about 4-1/2 feet above the ground.

BART’s own internal documents contradict the official claim that Hall was attacking or threatening Crabtree at the time of the shooting. Statements filed by several witnesses, and at least two BART police officers, suggest that Hall was more than 10 feet from the officer when the shots were fired, and was walking away. Medical records obtained by the Bay Guardian show that he was shot in the back of the head.

The shooting appears to violate nearly every modern police standard on the use of deadly force. In fact, the latest BART Police Operational Directive, dated July 22, 1987, states that guns may be fired only to prevent a suspect from killing or wounding another person, or to stop a suspected felon who is presumed to be armed and dangerous from fleeing and escaping arrest. But BART internal documents and other records obtained by the Bay Guardian provide little evidence to suggest that Hall fit either category.

Nevertheless, on Dec. 4, a BART Firearms Review Board, consisting entirely of BART police officers appointed by the chief, determined that the “use of lethal force in this instance was justified.” BART officials refuse to release the report or comment further on the findings.

The fact that Crabtree fired a gun to subdue Hall seems to undermine one of BART’s central reasons for the use of trained attack dogs. The dogs, BART officials say, are supposed to support officers in situations just like the one in question – to intimidate, and if necessary, pursue and immobilize a suspect when other backup isn’t available, and to attack immediately if an officer is under assault. Some law-enforcement experts, and many civil-rights advocates, question the use of dogs for that purpose – but all those contacted by the Bay Guardian agreed it was rather curious that Crabtree’s canine partner sat out this whole bloody incident.

Officer Crabtree is on administrative leave, with pay, pending the final outcome of an internal investigation. Owens is still facing robbery charges, despite the lack of a victim willing to testify against him. A preliminary hearing is scheduled for this week.

But the problems with the BART police go far beyond the arrest of John Owens and the death of Jerrold Hall. In fact, the Bay Guardian has learned:

BART’s Internal Affairs Division, which reviews citizen complaints against BART police officers, has investigated 162 cases in the past five years, 39 of them involving excessive use of force – and not a single charge was sustained. Law-enforcement observers say that’s an astonishing statistic, one that casts severe doubt on the department’s ability to control police abuse.

“I’ve never heard of any department with a rate of zero sustained complaints,” said John Crew, director of the American Civil Liberties Union Police Practices Project. “I can’t believe that none of those people had a single valid case.”

The BART Police Department has a written procedure for civilians filing complaints. A 1991 directive signed by Chief Harold Taylor states that every department employee should accept complaints by mail, by phone, or in person, and refer them to the watch commander or the Internal Affairs Division. But there’s nothing posted in any BART train or station to tell the public about the complaint process, no procedure for appealing a Police Department decision to a civilian review agency, and not much visible effort to inform BART employees about how to handle complaints.

The BART police use dogs for purposes inconsistent with many modern law-enforcement guidelines. Most local police agencies employ canines primarily to sniff out bombs and narcotics, or to search for dangerous suspects hidden in dark, confined areas. Berkeley has banned police dogs altogether. The BART police dogs are not trained to sniff out bombs or drugs, and are rarely involved in searches; the officers use the animals as standard backup, to intimidate and apprehend suspects in even fairly routine arrests.

The elected BART Board of Directors has demonstrated virtually no effective control over the BART police, and most board members don’t seem to know or care what their armed employees are doing with those badges, dogs, and guns.

None of the board members contacted by the Bay Guardian could even guess how many citizen complaints had been filed against the BART police since 1988, or what the outcome of the cases had been. None could explain the complaint procedure, or identify the person responsible for supervising internal investigations. Most didn’t know how the police chief was hired, or to whom he reported; some board members didn’t even know his name.

Several years ago, I asked Art Shartsis, a downtown lawyer who was then the BART Board president, if he knew who ran the BART police. His answer was unusually blunt, but entirely typical of the attitude board members show toward the force.

“I don’t know,” he told me. “I guess we must have a chief.”

A DAY AT THE MALL

Jerrold Hall was the son of Alameda Fire Department Captain Cornelius Hall, a retired Navy Reserve officer who lives with his wife, Rose and two other sons in a comfortable middle-class home in suburban Union City. Both of Jerrold’s brothers are in college, earning top grades; his aunt is the first black woman ever to serve on the Board of Trustees of Auburn University.

Jerrold, who graduated from high school in 1991 and was living with his parents, “had some problems, like a lot of kids these days,” his father told me. “But we hoped he’d outgrow them. He was a good kid, never into guns or killing or any of that sort of thing.”

On Sunday, Nov. 15, at about 2 in the afternoon, Hall met Owens at the Eastmont Mall in Oakland. According to a sworn statement Owens gave to the police, the two drank a few beers and part of a small bottle of E&J Brandy. Early in the evening, Hill invited Owens to his home, and they left the mall on an AC Transit bus to catch a BART train for Union City.

According to Owens and several other witnesses, Owens and Hill encountered a black man in his late 30s on board the train, and the man asked them if they wanted to buy one of the Walkmans he was carrying in a bag. When first questioned by police, at about 1:35 a.m., Owens said he declined the offer, went to another train car “where more girls were,” and met up with Hall again a few minutes later. At about 4:30 a.m., he made another statement, acknowledging that he was present when the friend he called “Glasstop” told the would-be salesman, “give me your Walkman.”

Several other witnesses on the train agreed that Hall had confronted the man, and walked away with a bag. None, including Owens, saw a gun.

However, the victim of what the BART police still call an “armed robbery” called the train operator on the intercom and said two men with a gun had stolen his Walkman. The operator, who never saw Hall or Owens, reported the incident, and it was relayed to BART police, who instructed the trainman to stop in Hayward, and, after a brief delay, to open the train doors. Hall and Owens left with about 50 others; according to the station attendant, they jumped the emergency gate and walked into the parking lot.

The police were able to find several eyewitnesses to the alleged robbery; however, other than Owens and Crabtree, who was the only police officer on the scene at the time, the internal report does not identify a single witness who actually saw the shooting.

An official Dec. 7 statement, written by BART Police Chief Harold Taylor at the request of the Bay Guardian and reviewed by BART’s legal department, notes that “witnesses disagreed as to the precise sequence of the next events.”

The internal BART police documents obtained by the Bay Guardian contain no formal statement or direct quotation from Crabtree; he apparently filed no written report. The reports were all prepared by other officers, who arrived at the scene after the shooting.

According to those reports, filed shortly after the incident, Crabtree approached Hall and Owens, who were standing near a bench in the parking lot’s bus-stop area, and ordered them to lie on the ground with their hands over their heads. Owens complied; Hall did not.

Hall, the reports state, “confronted and challenged Officer Crabtree, attempting to take Officer Crabtree’s shotgun from him at one point.” There is no mention of what the dog, who was trained to bite anyone who attacked Officer Crabtree, was doing at the time. BART officials refuse to elaborate, saying the incident is still under investigation.

However, one Bay Area dog trainer, who has trained police dogs, said it’s highly unlikely that a German shepherd of the sort imported by the BART police (see sidebar) would fail to respond in such a situation. “Dogs are very loyal and protective,” the trainer, who asked not to be identified, told the Bay Guardian. “These dogs are carefully bred and taught to attack anyone who physically endangers their human handler. Sometimes they overreact; they very rarely underreact.”

TO TAKE A LIFE

Owens told the police he “did not see the cop and Glasstop get into any physical fighting. They did not touch. They were just arguing.” After a few moments, Owens said, “Glasstop walked over to me and said we could go. So we started to walk away.”

Whatever the nature of the confrontation between Hall and Officer Crabtree, the police report and witness statements leave very little doubt that it ended with Hall walking away – and, as the internal police report states, “with Officer Crabtree retaining the shotgun.”

It’s also clear that some time, perhaps as much a minute or two, passed between the initial clash and the shooting – more than enough time for Hall and Owens to start walking away. During that period, the documents suggest, the passenger who had initially reported the robbery – and had not made any contact yet with police – suddenly ran out into the parking lot, pointed toward Hall and Owens and shouted, “That’s them.” Then the passenger fled.

Crabtree then ordered the two young men to halt again – and at that point, the statements get very fuzzy.

According to the official statement released Dec. 7 by BART, Crabtree “summoned his canine, but Hall resisted the dog.” A medical report filed by Alameda County emergency technicians who examined Hall after the shooting includes no mention of any dog bites or wounds of any sort other than those caused by the shotgun. A copy of the report, which has not been released, was obtained by the Bay Guardian.

Crabtree, the official BART statement continues, “fired a warning shot at a nearby tree. Hall continued to move toward the other suspect, and at one point turned and assumed a position which concealed his hands.”

The internal police report, however, states that Owens was the one who was “failing to keep his hands in view,” and who, in what the report described as “an effort to get rid of the evidence [Walkman],” put his hands into his pants pockets. At that point, the report states, Crabtree “used deadly force on suspect Hall.”

Owens said he responded immediately to the second command to halt, but that Hall kept walking away. When Owens heard the shots, he turned around, “and my partner was lying face down…. Then I heard all the cops coming with sirens.”

In fact, within a matter of minutes, at least three more BART police cars and a backup unit from the Hayward Police Department had arrived on the scene. Even if Hall, who by all accounts was walking, not running, had been attempting to “flee,” it’s unlikely he would have been able to get far.

And after an extensive search of the train, the tracks, the station, the parking lot, and everything else in the vicinity, the BART police acknowledge they were unable to find a gun.

Although the BART police initially insisted that Hall had been shot in the chest, and most of the news reports carried that statement unchallenged, even BART now admits that the shot struck the young man in the back of his head. His father, Cornelius Hall, never had any doubt.

“I’m a trained emergency medical technician,” he told the Bay Guardian. “I was in the hospital room when the nurse was washing down the body. I know what an entrance wound looks like, and my son was shot in the back.”

In Modern Police Firearms, a textbook on law-enforcement procedures, Professor Allen P. Bristow of California State University, Los Angeles, writes that deadly force should be used to stop a fleeing felon only when “he cannot be contained or captured” through other means. Further, Bristow notes, an officer considering deadly force should ask the following question:

“Is the crime this suspect is committing, or are the consequences of his possible escape, serious enough to justify my taking his life or endangering the lives of bystanders?”

The San Francisco Police Department guidelines on deadly force embody some of that same philosophy. “Officers shall exhaust all other reasonable means of apprehension and control before resorting to the use of firearms,” the Aug. 24, 1984, policy states. Officers are allowed to shoot at a dangerous, fleeing felony suspect “only after all other reasonable means of apprehension and control have been exhausted.”

San Francisco, like almost every other police agency in the Bay Area, and most in the country, strictly prohibits warning shots. So does BART: “Discharging of firearms [is] not allowable as a warning,” BART’s official weapons policy states.

The BART police are a bit more lenient than San Francisco on the use of deadly force to stop fleeing suspects. The officer must only believe that “the suspect is likely to continue to threaten death or serious bodily harm to another human being,” according to BART’s July 22, 1987, operational directive. Yet the directive also states that a firearm may not be used “when the officer has reason to believe … that the discharge may endanger the lives of passersby, or other persons not involved in the crime, and the officer’s life, or that of another person, is not in imminent danger.”

THE OPEN RANGE

Armed guards have patrolled BART trains and stations since the agency started running trains about 30 years ago. At first, they were simply known as “BART Security”; the officers had the authority to carry weapons and arrest suspects, but under state law, they weren’t members of a real police department. For the most part, that limited their authority to the confines of BART property.

In 1976, the state Legislature granted BART the authority to run a police department with jurisdiction and authority second only to the California Highway Patrol. BART officers now have full police powers, not only on their own turf, but in every one of the 58 California counties.

The department, headquartered near the Lake Merritt BART station, currently employs 151 sworn officers and nine dogs (see sidebar Page TK). An undisclosed number work undercover, in plain clothes, riding the trains and looking for crimes that range from fare evasion, “eating,” and “expectoration,” to assault, robbery, and rape. By far the most common crime, according to a BART police statistical breakdown for 1992, is “vagrancy”: 4,227 separate instances were reported by BART officers in the first 10 months of the year.

The BART Police Department has a $12 million annual budget, a fleet of patrol cars, and its own communications system. Officers earn salaries that Chief Taylor calls “competitive” with other departments in the Bay Area.

And at a time when California law-enforcement agencies are coming under increasingly strict civilian control, the BART police operate with nothing more than token oversight.

Chief Taylor reports to no commission, mayor, or city council. The department is administered by BART’s assistant general manager for public safety, who reports to the general manager, who reports to the board. BART spokesperson Michael Healy said the board plays no role in hiring or firing a chief, much less in disciplining police officers.

Former BART Board member Arlo Hale Smith said that in his term of office, the BART police chief rarely showed up for board meetings. “Even when we had something to discuss about the department – usually a labor-contract issue – the assistant general manager would come,” Smith explained.

Citizen complaints against the BART police are handled by the Internal Affairs Department, which is not a separate agency, as it is in many police departments, but a branch of the Detective Division, Taylor told the Bay Guardian.

That, some critics say, may explain why BART has the lowest possible rate of sustained complaints against its police officers. “There’s a very good reason for civilian agencies to handle complaints against the police,” said the ACLU’s John Crew. “People who have been abused by the police have a hard time trusting the same police department to do an honest investigation.”

Cornelius Hall, who is no stranger to government bureaucracy, said he ran into a stone wall when he tried to get some basic information about his son’s death from BART. “They wouldn’t even give me the police report,” he told the Bay Guardian. “The only way I can find out what happened to my son is to hire a lawyer and have it subpoenaed.”

Crew said he finds the situation “chilling.” He said he saw a “complete dearth” of civilian oversight in the BART administrative structure. “There’s no opportunity for meaningful public input, for hearings, for discussion of issues,” he continued.

“It’s not an acceptable situation. But under the circumstances, the members of the BART Board have an increased responsibility to ask questions and keep on top of their police department’s practices.”

In the case of Jerrold Hall, at least, that doesn’t seem to be happening. The shooting hasn’t been on the agenda for any board meeting since Nov. 15, and board members say they haven’t received any information about it from BART management.

And unlike Cornelius Hall, they haven’t even bothered to ask.

TO TELL THE TRUTH

The day after a BART police officer shot Jerrold Hall in the back of the head, transit agency spokesperson Mike Healy told reporters that Hall had been shot in the chest.

Not true.

Healy also told reporters that Hall had attacked Officer Fred Crabtree, and continued to attack him after Crabtree fired a warning shot.

Not true.

And Healy said that the warning shot was fired “over Hall’s head.”

Not true, either.

Healy freely referred to an alleged “armed robbery,” but he didn’t tell reporters that BART police had searched the entire area and never found a gun. He didn’t say that the alleged robbery victim had vanished without a trace, either.

So the public got a one-sided – and, as it turns out, largely inaccurate – picture of the incident. The press, taking Healy’s information at face value, portrayed Jerrold Hall as a violent, gun-wielding punk, shot in the act of attacking a cop.

“In some ways,” says Hall’s father, Cornelius, “that’s the saddest part of all.”

And while Healy finally put out a statement Dec. 7 acknowledging that some of his previous comments were in error, he did so only after a three-week barrage of questions from the Bay Guardian – and he never issued a word of apology to the Hall family.

It’s hard to blame Healy for the initial round of misinformation: In the heat of a bloody battle, the truth is often obscured. But Healy clearly knew, or could have known, within a few days after the incident that his official press statements had been wrong – that, for example, the medical reports showed Hall had been shot from behind. He could have called the reporters who were covering the story and let them know, or issued a new press release with updated information.

He could have tried to rescue some of what was left of the dead 19 year old’s personal reputation – and salvaged a bit of his own in the process. Instead, he fell back on the old BART strategy: When in doubt, stonewall. Then duck for cover, and hope it will all go away.

The BART Police Department may be the least-responsive law-enforcement agency I’ve seen since the discovery of the shredding machine in the White House basement. There is no press officer. The watch commanders, lieutenants, and captains refer all press calls to Chief Harold Taylor, who won’t come to the phone; his secretary refers the calls to the BART Public Affairs Office.

When I first called Healy Nov. 16 to ask about the shooting, he told me he hadn’t seen a police report, and didn’t know if one existed. He also said he didn’t know what the citizen complaint procedure was for the BART police, and had no idea if it was in writing. I filed a formal request for those and other records Nov. 17; under the Public Records Act, I had a legal right to a response within 10 days.

I let it slide to 15 days (holidays and all), then started calling Healy’s office. He was too busy to come to the phone at first, but after I harassed him for several hours, he told me that Chief Harold Taylor was handling my request, and that I should call him directly. Taylor wouldn’t come to the phone at all: He had an assistant tell me that Public Affairs was handling the request, and that I should call Mike Healy.

I spent another day trying again to reach Healy, who finally told me he wanted to set up an interview with Taylor – for Dec. 4, 17 days after I’d sent in a request for information most police agencies would probably have provided in less than an hour.

Chief Taylor showed up for the interview with a BART lawyer, who promised that the chief would fax me a statement of the facts of the shooting sometime later that afternoon. The brief, incomplete statement finally arrived three days later, around 3:30 p.m. Dec. 7, 21 days after my initial request. And BART officials still won’t release the full police report.

If I were a suspicious reporter, I’d wonder what they were trying to hide.

Deputy dog

In Philadelphia, the Inquirer revealed several years ago, police dogs attacked 358 people in the course of 33 months, leaving many of them scarred or maimed for life. In Los Angeles, the Times recently reported, the local K-9 Corps recorded more than a thousand bites in three years. In Washington, D.C., and Baltimore, trained German shepherds tore into a total of 375 legs, arms, and torsos in the course of their law-enforcement work.

In the past 10 years, canine corps scandals have tarnished the reputations of police departments all over the country and have cost taxpayers millions of dollars in lawsuits.

In Berkeley, however, police dogs have been banned since the early 1970s, when a City Council member named Ron Dellums responded to the brutal use of dogs against blacks in the South with a resolution abolishing the local canine corps. In San Francisco, dogs handle only a few very limited tasks.

But since 1990, the BART Police Canine Corps has been expanding into the sort of work that created such extensive problems in other American cities – a use for dogs that critics say has little justification.

“There are two basic rationales for using police dogs,” explained Richard Avenzino, director of the San Francisco SPCA, whose agency has worked with the local Police Department canine program. “One is for sniffing out explosives or narcotics. The other is for searches, mainly in enclosed spaces, where the dog’s sense of smell can aid in finding a hidden human suspect.

“But there’s also a perception that a snarling dog can intimidate people, which creates a lot more potential for trouble.”

The first BART Police canine corps dates back to the early 1970s. But the BART Board disbanded the program in 1975, after a police dog on a train in Philadelphia barked at BART Director John Glenn.

In 1990, Police Chief Harold Taylor restored four dogs to the force, saying they would be “a strong statement of police presence,” would deter violent crime, and could be used to help clear homeless people from trains and stations. In an interview last week, Taylor said the dogs, which now number nine, are used “to back up officers, in all their law-enforcement duties.”

The dogs, imported German shepherds, are bred and undergo Schützhund training at a special school in Germany, where they learn to attack on command. “The dogs only [understand] German,” explained Deputy Chief Kevin Sharp. “The officers learn to issue their commands in that language.”

Sharp said none of the BART dogs are trained to sniff out bombs or drugs and that they aren’t often needed for searches. In normal situations, he said, the dogs stay in the police car, with the window open, while the officer approaches a suspect. “They’re trained to jump out and attack without any command if they see that the officer is under assault,” he added.

ACLU Police Practices lawyer John Crew found that description alarming. “In other words,” he said, “we have dogs deciding on their own when to use what amounts to lethal force. That’s not a very good idea.”

Avenzino said the training methods used for such dogs “are, to put it mildly, controversial. A dog will do anything to please its owner; if you teach it to attack on command, it’s like loading a gun. In my opinion, it’s very dangerous.”

Jim Chanin, a Berkeley lawyer who has filed several lawsuits over attacks by police dogs, said he sees no good reason for BART to have a canine corps. “The problem is that these dogs are just trained to attack,” he explained. “You can’t use them to search for some kid lost in the BART tunnel.

“If there’s something the BART police do on a regular basis that requires the use of dogs, I certainly can’t see what it is.”

Chief Taylor told the Bay Guardian that dogs provide much less expensive backup than additional sworn officers. Berkeley Police Lt. Tom Grant said he agrees, to a point: “But then you have to pay out those big legal settlements if one of the dogs does something wrong.”

Gun crazy

Bruce Seward imploded while riding an AC Transit bus.

It was 4 a.m. on May 28, 2001, and Seward was rolling through the darkness on the 82 line, headed south from Oakland toward Hayward. Hands clapped over his ears, Seward, a 42-year-old car salesman, rocked back and forth, vacilutf8g between sobbing and shouting. He was barefoot, according to witnesses.

Bus driver Anthony Ramsey heard Seward ranting, “They trying to kill me, they trying to kill me.”

“Shut up!” one passenger screamed. Another rider threatened to toss Seward off the bus.

Seward morphed, gaining some inner – momentary – calm. “Thank you, God, thank you, God, thank you, God,” he chanted.

A few weeks earlier Seward had jetted to Danville, Ill., for his mother’s 67th birthday; his mom and eight siblings didn’t notice any behavioral peculiarities. But now, quite publicly, the Oakland man’s synapses were misfiring.

At the end of the line, the Hayward BART station, Seward got off the bus. An hour later a veteran BART cop named David Betancourt found the rangy African American man outside the station, lying next to a Dumpster, naked and semi<\h>coherent. Betancourt, according to confidential police reports obtained by the Bay Guardian, grabbed Seward and shook him. “Are you OK?” the cop yelled.

“No,” Seward shouted, standing up. “No, it’s not OK.”

Betancourt, police reports indicate, says Seward then charged him. Yanking a can of pepper spray off his belt, the cop blasted the naked man in the face. The chemical spray did nothing.

Then, according to witnesses, Seward grabbed Betancourt’s 26-inch-long wooden nightstick. The officer – as he would later tell his superiors – began to fear for his life. Betancourt said he thought Seward would “beat [him] to death” with his own baton or attempt to disarm him and shoot him.

The cop drew his blued steel Glock and squeezed the trigger, dropping Seward with a single .40-caliber slug through the heart.

Seward’s demons are buried with him. Family members have few clues about why his mind melted down. They know he survived a similar psychotic episode in the early 1990s. And they know he went to see a psychologist two days before he died. It seems his relationship with an Oakland woman was collapsing; maybe the emotional turmoil had shattered him.

Betancourt, who has 20 years of law-enforcement experience, 8 of them with BART, emerged unharmed from the fatal skirmish; police records show the officer suffered no injuries. His career seems undamaged as well: Betancourt returned to active duty last week after probes by the BART police and the Alameda County District Attorney’s Office cleared him of any wrongdoing. The cop had been on paid administrative leave since the incident.

“It’s unfortunate that somebody died, but the officer was justified in using deadly force that morning,” Betancourt’s attorney, Leo Tamisiea, said.

BART police chief Gary Gee concurs. “I think he acted appropriately,” Gee told us. “The tussle that took place, the back-and-forth exchange – when it had no effect on [Seward] and the officer feared that he himself was going to suffer serious injury or death, he took the action he felt necessary.”

Regardless of BART’s official line, a key question remains: did Betancourt really have to kill Seward? It’s a question neither asked nor answered in the 90 pages of BART police reports leaked to this paper.

“My brother would still be alive today if the officer was doing his job correctly,” Michael Seward, 45, an Illinois state prison guard, told us. “I can’t see any justification for shooting an unarmed civilian.”

According to almost every major U.S. police department’s official guidelines – including those of the BART police – a cop can use deadly force only if the cop reasonably believes his or her life (or the life of another person) is in immediate jeopardy.

Did Betancourt truly think Seward was going to bludgeon him to death? And if so, was the cop making a realistic assessment of the situation? These questions, too, are unresolved by the investigations of BART and the D.A.’s Office.

The subway system has offered Seward’s family only fragmentary information about case number 01-22334. “The hardest part is that we’re not getting any help from the police department,” Michael Seward said. “I have not received an autopsy report on my brother. We’re trying to find out what actually happened, and the police have not been forthcoming in terms of giving us an accurate, detailed explanation of what happened.” The family is contemputf8g a lawsuit.

Lurking in the police documents leaked to this paper is one fairly startling fact: “Officer Betancourt’s duty weapon left the scene with him,” one chronology of the incident reads. Two hours after the killing, Betancourt turned the Glock over to investigators. “That’s totally against protocol,” said former Santa Monica cop Frank Saunders, a consultant on police practices. “In these cases, you’re supposed to take the officer’s weapon immediately.”

“I don’t know why there are time gaps in the reports,” BART spokesperson Mike Healy admitted.

For Samantha Liapes, director of Bay Area PoliceWatch, Seward’s death is symptomatic of a broader problem. “We’re very troubled by this: yet another example of unwarranted deadly force being used in a situation where someone was obviously in mental distress,” Liapes said. “The fact that the man was naked and clearly not carrying a life-threatening weapon makes the use of deadly force by the officer even more troubling.”

Two weeks after Seward was killed, San Francisco cops put 20-some bullets in another mentally ill man, Idriss Stelley, in a movie theater at Sony Metreon. Stelley, according to his mother, was brandishing a less-than-lethal, two-inch-long knife.

Beyond the specifics of the two cases, there’s a larger policy issue: are local cops getting the proper training in how to handle mentally ill people?

As required by state law, BART – along with most other Bay Area departments – gives new recruits six hours of schooling on the subject. “We are sensitive to the fact that there may be a need for additional training and are receptive to looking into it,” BART chief Gee said. “But I’m not so sure that even if Betancourt had gotten supplemental training on dealing with persons who are mentally ill, that it would have changed the outcome in this case.”

The chief could take a cue from San Jose, which has put 130 of its officers through a 40-hour training on mental health crisis calls.

Lt. Brenda Herbert, head of the San Jose Police Department’s Crisis Management Unit, runs the training program, which was launched in 1998. “What we’re trying to do is teach officers to talk someone down, rather than take them down physically,” Herbert says. “It’s a matter of teaching these officers what it means to be hearing voices, how to talk to someone who’s hearing voices, how to find out what the voices are saying so that you can take the necessary precautions.”

Seward is not the first person to bleed to death in the parking lot of the Hayward BART station. It was there, in 1992, that BART cop Fred Crabtree confronted Jerrold Hall, a 19-year-old African American. Hall, who was getting off a train with a pal, fit the description of a robbery suspect. Crabtree – armed with a baton, a can of pepper spray, a handgun, a shotgun, and an attack-<\h>trained German shepherd – told Hall to halt.

After a quick discussion Hall turned and walked off, his hands clearly visible. Crabtree ordered him to stop. When Hall failed to heed the command, the cop loosed the 12-gauge shotgun, blasting the young man in the back of the head.

As it turned out, no evidence was ever found connecting Hall to any robbery – and he was unarmed (see “BART Cops, 41-0,” 1/14/98).

BART came under public pressure to fire – or at least discipline – the officer. Politicians made noises about putting the subway system’s largely unaccountable 182-<\h>officer force under the supervision of a civilian review board.

Apparently unswayed by reason, BART officials did absolutely nothing, and eventually the public discontent tapered off. Crabtree remained on active duty until his own inglorious demise a few years later: the officer was found hanging from a noose in his home as porno tapes played on the TV.

Interviewed last week, Tom Radulovich, a member of the BART Board of Directors, said he’s pushing for more police oversight but at this point doesn’t have the votes on the nine-member board to pass any new rules. It may prove especially hard to muster those votes in the fear-<\h>laden post-Sept. 11 climate.

“The concern the [Seward killing] triggers for me is whether we’re doing enough to make sure things like this don’t happen,” Radulovich said.

It could be that David Betancourt really had no choice but to gun down Bruce Seward. Maybe it really was a kill-or-be-killed situation.

There is, however, another, more grim possibility: that the police culture at BART has changed very little in the last nine years. And the majority of the BART board doesn’t seem to care.

Beware the BART police

The coverage on KTVU of the latest BART police shooting shows what TV news can do at its best. While the Chron was relying on official accounts and some witnesses, KTVU got two sets of cell-phone videos that show the horror of the shooting in black and white. Then there’s the painful press conference when a BART spokesman talks about the safety of the passengers and says it’s “regrettable” for someone to die.

But what’s been missing in most of this discussion is the fact that this is nothing new — the BART police have been involved in improper shootings at least twice previously — and in both cases, the officers were cleared of any wrongdoing.

The big problems is that BART has no civilian oversight for the police. There’s no BART Board committee that monitors the BART cops, no independent investigative agency, nowhere except the BART Police to file complaints against the BART police. It’s the only major police agency in the Bay Area that operates with zero effective civilian oversight.

Here are two alarming examples of past police abuse:

1992: A BART cop shoots and kills an unarmed man who is walking away.

2001: A BART cop shoots an unarmed naked man.

I asked BART Board member Tom Radulovich today if there’s any way this incident will finally lead to a movement for civilian oversight of the BART police. He said he favors that — but he’ll need more votes. Here’s the BART Board president and vice-president. Mayor Newsom’s YouTube hypocrisy

OPINION Mayor Gavin Newsom’s "State of the City" YouTube fiasco — in which city SFGTV employees helped create 7.5 hours of non-mandated programming — is complete hypocrisy.

While the mayor touts technology and transparency of his efforts, he has opposed using available technology to broaden access to public meetings in City Hall, even though that is now mandated under the Sunshine Ordinance. Why are we getting Internet speechifying, rather than transparent access to City Hall meetings?

If you’ve ever wanted to listen in on what are now essentially secret, backroom policy discussions and decisions being made in San Francisco’s City Hall, you’re not alone.

If you’ve ever imagined being able to hear those conversations — while you’re sitting at home or in your office, during your drive to work, while on Muni/BART, enjoying a java in your favorite café, or really anywhere — the technology is already in place. You could use your iPod or MP3 player, or listen to a podcast, similar to using Books on Tape.

Right now only about 30 of the 80-plus regular City Hall meetings are televised and posted online for on-demand or downloaded viewing. Some of the remaining 50-plus meetings are at least audiotaped, but they require awkward and costly procedures to obtain them.

In an effort to increase transparency of San Francisco’s government, Sup. Ross Mirkarimi introduced legislation earlier this year to expand the recording mandate and require online posting within 72 hours after a meeting. Currently only policy bodies must audiotape their meetings, but Mirkarimi’s mandate extended the recording requirement to other City Hall agency and departmental hearings, and to lesser-known passive meeting bodies. It was such an obvious and popular idea that the Board of Supervisors overwhelmingly supported it and subsequently overrode Newsom’s veto.

Newsom continues to claim the enhanced transparency mandate would be too costly, but simple research has shown that the city has all the equipment, contracts, and staff in place to implement Mirkarimi’s transparency mandate today. In fact, any laptop or $40 digital recorder can make the recording, and posting online is similar to the few steps needed to upload a YouTube video.

It appears the mayor just doesn’t want anyone to see the sausage he’s making, unless he can script and control it. Other City Hall bureaucrats blocking this include Jack Chin, head of SFGTV; Angela Calvillo, clerk of the board; and Frank Darby, Calvillo’s administrator of the Sunshine Task Force. They all raise spurious complaints, pass the buck, and refuse to discuss reasonable accommodations, apparently following mayoral prohibitions despite the board’s veto override.

The Sunshine Ordinance requires all civil servants to prioritize compliance over any other duties when there is a conflict, and failure to obey the law is official misconduct.

It’s sad that Newsom, city employees, and City Attorney Dennis Herrera are doing everything they can (by action or by ignoring these daily violations) to prevent the ability of the media and the public to have this transparency. Needless to say, with the looming city budget deficit, our interest in following these detailed machinations is at an all-time high.

We should demand that City Hall’s foot-dragging cease, by implementing Mirkarimi’s legislation immediately.

U Don’t Hustle U Don’t Eat, the appropriate title of the March 2009 album by up-and-coming Menlo Park-East Palo Alto rapper A.G. Cubano, pretty much sums up the state of the once vibrantly lucrative local rap music economy. Profit-wise, it has steadily slid and deteriorated during the past decade amid an extremely tough and competitive environment, forcing artists into creative ways of generating cash.

"It’s ugly out there," said Walter Zelnick of City Hall Records in San Rafael, which has distributed independent local hip-hop since its beginnings in the 1980s. "Numbers are down all around. The numbers of stores out there are down. I don’t think kids even buy CDs anymore." San Francisco’s Open Mind Music, which closed on Halloween, and Streetlight Records in Noe Valley, which closes Jan. 31, are just two of latest retail victims.

"Just getting in the stores is hard as fuck nowadays. I didn’t realize it had gotten so bad," said Dave Paul, whose prolific long-time local indie label just released the Bay Area artists-filled Bomb Hip-Hop Compilation, Vol. 2, a sequel to the 1994 premier volume, which sold way more than the "maybe 600 or 700 CDs" he expects to move of the new disc.

Zelnick also fondly recalls the golden 1990s when local rap compilations like D-Shot’s Boss Ballin’ (Shot, 1995) and Master P’s West Coast Bad Boyz: Anotha Level of the Game (No Limit, 1995) would sell in numbers that now often qualify as No. 1 on Billboard‘s national pop albums chart. "When [E-40’s group] the Click first came out, they were selling over a 100,000. But then sales for artists went down to 50,000 or 40,000," Zelnick said. Now "average CD sales are more like 2,000. And many people are lucky to sell that."

"It’s not as nearly as easy as it once was out here when we could fuck around and sell 50-, 60-, 70,000 copies independently," said longtime Fillmore rapper San Quinn who just released From a Boy to a Man (SMC) and will soon follow up with the collaborative Welcome to Scokland (Ehust1.com) with Keak da Sneak. "I literally grew up in this Bay Area independent rap scene."

Known for his affiliation with JT the Bigga Figga’s Get Low Playaz and more recently for his ongoing feud with his cousin rapper Messy Marv, the 30-year-old rapper is a well-established artist. But even a high-profile performer like Quinn accepts that he will be lucky if he sells the 22,000 that his last solo CD, The Rock: Pressure Makes Diamonds (SMC) tracked on SoundScan. That was in 2006, two long digital years ago. As with many veteran rappers, downloaded music has hurt San Quinn. "The majority of my fans are white boys and Latinos and Asians that have that shit mastered," he said. "And it’s even harder for someone like me who is based out of the capitol of technology here in the Bay Area, home of Silicon Valley."

"Since the selling of CDs in stores has gone down, way down, everyone has had to step up their game," Cubano said. Two months before the release of U Don’t Hustle U Don’t Eat, the shrewd rapper will pave the way with the Feet to the Street mixtape in collaboration with Oakland’s Demolition Men, the accurately self-described "Bay Area mixtape kings," whose trusted brand has helped further fuel the careers of such local rap faves as J-Stalin, the Jacka, and Shady Nate. San Quinn and the Jacka, as well as C-BO and Matt Blaque, are among the names the ever-resourceful Cubano has enlisted for his upcoming releases.

"But then there are so many different ways to make money nowadays," Cubano added. "You can get money out of ringtones. You can sell your songs one at a time for $1 a piece on iTunes or from your MySpace even now. I love MySpace. It is great in so many ways, like connecting with artists straight away and not beat around the bush, waiting for a phone call, or waiting for a nightclub to see someone."

MySpace is also San Quinn’s lifeline where, the rapper said, his music’s daily plays are in the thousands. San Quinn generates money beyond CD and digital music sales. "I do ringtones. I do shows. I have a San Quinn skateboard that I put out through FTC," the rapper said. "On our first pressing we just had, I sold a thousand skateboards at $50 a piece and I get $25 off every skateboard."

He also makes a tidy income doing guest appearances or "features" on other artists releases ("They pay me for a verse"). "I’ve done over 3,000 features," he said of the feat that earned him an inclusion in Guinness World Records for the most collaborations with other artists. Landing on television or video game soundtracks can be highly profitable but also highly competitive.

But for an up-and-coming Bay Area hip-hop artist, it is even more challenging to make a buck. On one recent evening on the Pittsburg/Bay Point-to-San Francisco BART train, Macsen Apollo of Oakland’s V.E.R.A. Clique was putting a new spin on the "dirt hustlin’" sales approach pioneered in the 1990s by Hobo Junction and Mystik Journeymen by walking from car to car hawking copies of his hip-hop group’s CD, keeping a watchful eye out for BART police, in an effort to make some money from his music.

Meanwhile back at the City Hall Records offices and warehouse, where Zelnick works on orders for new releases from local rap cats Balance and Thizz artist Duna, things have changed a lot in a decade. "We’re really at a turning point here," he said. "We’re still here and someone is buying music, but I don’t know how much longer." Last week in the UK, with just a few weeks till Christmas, Britain’s key indie label distribution company Pinnacle Entertainment declared bankruptcy, leaving 400 imprints with no way to get their music into the diminishing number of music retail stores.

"Next year I ‘m going to put out Return of the DJ, Vol. 6 and that will be the final physical release I will ever do," said Bomb’s Paul, who believes the only way for rap artists to make money is to be increasingly innovative and to constantly tour and sell merchandise, including music, along the way. "In the very near future I think the only place left to buy a CD is to go a show. Artists have to come up with new ways to generate cash. I heard of some artists who will sell backstage passes for $300 — or whatever they can get."

Cubano concurs. "If you’re sitting around waiting for that call, it ain’t gonna come," he quipped. "You have to get out there. You gotta be in traffic. People have to expand their hustle. Otherwise you don’t eat."

PREVIEW The Bay Area is no stranger to outdoor projection: the past few years alone have brought Melinda Stone and Liz Keim’s "A Trip Down Market Street" program; a series of "Illuminated Corridor" get-togethers in Oakland; and of course, numerous installments of Film Night in the Park. But Michael Damm’s "incidental films for an accidental audience" is something new — a more ephemeral, relatively (in the artist’s words) "unannounced" projection event taking place in various transit spaces or zones. "I’m interested in the anonymity of people seeing [the projections] in passing," Damm explains, during a recent phone conversation. "It presents a different way of thinking about how people see things. A glimpse can be an interstice — a glimpse in passing can leave a question hanging."

Though "incidental films" is an extension of an ongoing project with Portland, Ore., curator Stephanie Snyder, Damm happened upon the idea of projections shortly after moving from SF to the East Bay. "Oakland is a lot more about driving, and about the freeway," he says. "I became curious about those transit corridors." Damm found himself drawing ideas from the German architect and urban planning theorist Thomas Sieverts, in particular Sieverts’ idea of the Zwischenstadt, or "in-between city." Though Damm is guarded about the specific visuals he’s projecting, expect to see views of life-in-motion as you speed past his sights or sites.

Throwing money at Muni

I’m not surprised that C.W. Nevius, who lives in the East Bay suburbs and drives into work at the Chron every day, doesn’t like the idea of congestion pricing.

But his column doesn’t entirely add up. I mean, I though he likedmodern capitalism, which is an economic philosophy based on incentives. You give people an incentive to drive downtown — like free or cheap parking — and you never charge them for the external costs of their actions, and they are, by and large, more likely to drive. You take away that incentive — by, say, charging a fee that reflects in some modest way the additional costs to the city, the environment and society as a whole of their behavior — and driving downtown may diminish. That’s pretty basic stuff.

But he’re the big mistake:

It makes you wonder about the numbers the proponents keep throwing out. Between $35 million and $60 million will be generated each year, they say. Add that to the funds the advocates hope to get from the federal government, and they insist it will all come together. The money will dramatically improve mass transit, fewer people will want to drive in the city, and more of them will happily get aboard the bus, or BART, or Caltrain.

Let’s see, just throw more money at public transit and everything will improve. Have we heard that before? You bet we have and the problems persist.

I recognize that throwing money at the problem doesn’t solve everything. It’s not always the smartest thing for government to do, and often it doesn’t work at all.

But public transportation, like public education, is an area where throwing money around really does make a difference. Spend more on Muni and Muni gets better. Cut Muni’s budget and service gets worse. There are other factors (the competance of management etc.) but on a linear regression line, the correlation between money and quality or service is going to be pretty direct.

The reason mass transit isn’t up to Nevius’ standards is mostly because we don’t fund it adequately. Making the (mostly wealthy) people who drive — and pollute the air and contribute to congestion and global warming — pay a small fee to offset just a part of those costs, and use that fee to improve transit, makes perfect sense.

This promotion is a collaboration between SF Economic & Workforce Development, SF Office of Small Business, SF Convention and Visitor Bureau, SF Chamber of Commerce, Hotel Council, MTA, MUNI, DPT, BART, Chronicle, Examiner, Business Times and Bay Guardian to encourage people throughout the nine county Bay Area to shop in San Francisco. San Francisco could raise $35 million to $65 million for public transit improvements annually by charging drivers $3 to cross specific downtown zones during peak travel hours, according to a San Francisco County Transportation Authority congestion pricing study.

The aim of those fees, SFCTA staffers say, is to reduce congestion, making trips faster and more reliable, neighborhoods cleaner, and vehicle emissions lower, all while raising money to improve local and regional public transit and make the city more livable and walkable — improvements they hope will get even more folks out of their cars.

London, Rome, and Stockholm already have congestion pricing schemes, but plans to charge congestion fees in New York got shelved this July, reportedly in large part because of New Jersey officials’ fears that low-income suburban commuters would end up carrying a disproportionate burden of these fees.

As a result of New York’s unanticipated pressing of the pause button, San Francisco now stands poised to become the first city in the United States to introduce congestion pricing. But the plan requires approval from both local officials as well and the state legislature.

As SFCTA executive director Jose Luis Moscovich told the Guardian last week, "The state has control over passage of goods and people. Therefore, if we want to restrict that in any way, e.g. charging a congestion fee, [we] have to get the state’s permission."

If a congestion pricing plan is to go forward, it will need the support of Mayor Gavin Newsom. Wade Crowfoot, the mayor’s climate change advisor, told us, "It’s obvious that the mayor embraces the concept, as he laid out in his 2008 inaugural address."

But Newsom isn’t signing the dotted line just yet. "The mayor wants to make sure that there are no negative impacts that would make people not want to come to San Francisco, or would harm low-income people who live in areas that are not served by public transit and have no other choice but to drive," Crowfoot said.

"We are encouraging the [Transportation Authority] to do vigorous public outreach so that no one feels blindsided," Crowfoot added.

But as SFCTA executive director Jose Luis Moscovich explained Nov. 25 to the supervisors, who also constitute the transportation authority board, even if San Francisco gets the legislative green light, it could take two to three years to implement a congestion pricing plan.

"We’re not making a proposal," Moscovich said. "We’re just showing the initial results of our analysis."

That said, it’s clear Moscovich believes congestion pricing is feasible and would contribute to local, regional, and statewide transit goals.

TOO MANY PEOPLE


With San Francisco planning to accommodate 150,000 new residents and 230,000 new jobs over the next 25 years, Moscovich’s principal transportation planner, Zabe Bent, outlined four scenarios last week that would mitigate impacts in already congested areas.

These scenarios involve a small downtown cordon, a gateway fee with increased parking pricing downtown, a double ring that combines gateway crossings with additional fees downtown, and a cordon that imposes fees on crossings into the city’s northeast corner. (See www.sfmobility.org for details, including maps of the four possible zone scenarios.)

It seems likely the SFCTA will pursue the double ring or northeast cordon option.

As Bent told the board, "If the zone is too small, people will drive around it. And drivers within the zone could end up driving more, thereby eroding anticipated congestion benefits."

But all four scenarios aim to alleviate an additional 382,000 daily trips and 30 percent extra time lost to traffic congestion that would otherwise occur by 2030, according to SFCTA studies.

"We won’t reach environmental goals through clean technology alone," Bent explained. "Even if everyone converted to a Prius, the roads would still be congested."

Observing that it already costs at least $4 to get into the city by car — on top of $2 per gallon for gas and high parking fees — Bent argued that congestion, which cost the city $2 billion in 2005, reduces San Francisco’s competitiveness and quality of life.

Stockholm raised $50 million a year and reduced congestion by 22 percent with congestion fees, while London raised $200 million a year and reduced congestion by 30 percent.

In San Francisco, the SFCTA used computer models to determine that by charging $3 per trip at peak hours, the region would get maximum benefits and minimum impacts.

Discounts would be available for commercial fleets, rentals, car shares, and zone residents, Bent said, with toll payers getting a $1 "fee-bate" and taxis completely exempt.

As Moscovich noted, "Taxis are viewed as an extension of the public transit system."

BIG BUSINESS GRUMBLES


With concerted public outreach scheduled for the next two months, and business groups already grumbling about even talking about any increases to the cost of shopping and commuting with the economy in meltdown, Moscovich warned the supervisors not to wait until after the next economic boom hits, before planning to deal with congestion.

"Now is the right time to study it, but not implement it yet," Moscovich said.

Kathryn Phillips of the Sacramento-based Environmental Defense Fund told the Board that in Stockholm, public support grew to 67 percent once a congestion fee was in place.

"People saw that it reduced congestion, provided more public transit services, and made the city more livable and walkable," Phillips said.

BART director and Livable City executive director Tom Radulovich believes that free downtown transit would make the fees more palatable. "Fares could be collected when you get off the train if you travel outside of the zone," Radulovich said.

Noting that BART is approaching its limits, Muni Metro needs investments, and parking fees are an effective tool for managing congestion, Radulovich added. "Congestion pricing’s main criteria should not be to make traffic move faster. I don’t want to create more dangerous streets, but generally speaking, I think that plan is on the right track."

As for fears that San Francisco’s plans could tank at the state level because of concerns about working-class drivers being unfairly burdened, Radulovich noted that SFCTA studies at Doyle Drive determined that only 6 percent of peak hour drivers are low-income.

"The vast majority are earning more than $50,000 a year," Radulovich said. "And since the number of low-income drivers is very small, they could be given discounts. The real environmental justice issue here is what current congestion levels are doing to people living downtown, who are mostly low-income. They put up with inhumane levels of traffic and congestion, which affects the health and livability of their neighborhoods."

Dave Synder, transportation policy director for SPUR (San Francisco Planning and Urban Research Association), said he believes the regressive tax argument is a misleading attack.

"The truth is, that without the revenues this program will bring, the MTA will have to cut service for poor people, not increase service to meet increased demand for people who can no longer afford to drive," Synder told us.

But several local business groups are claiming that San Francisco doesn’t have a congestion problem compared to European cities.

Ken Cleveland of San Francisco’s Building Owners and Managers Association, said he believes that reports of congestion in San Francisco "are more hype than reality.

"We have no problem compared to London, Rome, and Stockholm," Cleveland said. "Congestion fees may work when you have a huge city with millions of people crammed in, like in London, Manhattan, Rome, but not in San Francisco."

Cleveland urged a hard look at what this increase means for people who drive now. " Fees of $160 a month would be "a real hit" on the middle and working classes, he said.

Jim Lazarus of the San Francisco Chamber of Commerce said he opposed a local cordon, but supports a regional congestion pricing program. "Look out the window at 10.45 a.m., and you’ll see that there is no congestion on Montgomery and Pine," Lazarus told us, noting that unlike London, which covers 600 square miles, San Francisco only has a 49-square-mile footprint.

"If you decide not to go into downtown London, the odds are your taxes, jobs, and revenues will still go into London’s coffers," he said. "That’s not the case in San Francisco. So from a small business point of view, it doesn’t make sense."

Bent says the SFCTA’s study provides numbers that are irrefutable, in terms of showing how travel times are impacted by congestion, during peak hours. "We’re talking about modest improvements in speed, but significant improvements in travel time," Bent said.

The proposed fees won’t affect shoppers, museum-goers, or those going out at night, but would benefit all users of the public transit system, Moscovich said.

"We’re not designing for London, we’re designing for San Francisco," Moscovich told the Guardian. "And this is not an anti-automobile program. This is an effort to achieve a balanced transportation system."

With the congestion fee revenue reinvested in transportation infrastructure, Moscovich adds, public transit will be less crowded, and provide more frequent, faster service.

"It all makes perfect internal sense: folks with the least resources are likely to benefit the most," said Moscovich, who predicts that San Francisco will agree on some form of congestion pricing.

"The mayor wants to be seen as a leader in initiating climate change commitment, and transportation is one of the first ways to achieve this," he said. "Especially since 50 percent of San Francisco’s greenhouse emissions occur during peak hour travel."

"We’re trying to change behavior, not just engineering. We don’t want people in cars. … For every pollution-free Prius, you have diesel buses and older cars sitting in traffic idling, essentially eroding any benefits. The best way to optimize results is to get some cars out of the peak hour."

Sup. Jake McGoldrick, who is president of the SFCTA board and has supported the congestion fee-pricing system since it was implemented in London, said that "business will have to step up [and] make a willing suspension of disbelief to see that enhanced mobility will enhance business opportunities.

"There will be no need to get mauled at the mall," McGoldrick predicts. "San Francisco has wonderful things to offer, not just a sterile, homogenous, single-purpose environment. You can’t match museums and cultural amenities out at the malls. San Francisco is a cultural center, not just a strip mall."

McGoldrick, who is termed out in January, said that the new Board "will lean very positively toward doing this." He added that state representatives, including Sens. Leland Yee and Mark Leno and Assembly Members Fiona Ma and Tom Ammiano "will see the benefits.

"They should be willing to carry the banner because of the long term benefits for their grandchildren," McGoldrick said.

It’s that time of year again: stores are hanging up wreaths of holly, people are stringing Christmas lights and taking their menorahs out of storage, and you’re scrambling around the city, without enough money or time, trying to find the perfect gift for everyone on your list and cursing mindless consumption. SONIC REDUCER Been down so long that the initial whooping, joy-drenched Obama-phoria of Nov. 4 felt — at least before learning of Proposition 8’s passing — like that moment during the flannel-flying whirl of the early ’90s, when the world finally seemed like Kim’s playground. When everywhere I looked, ultra-cool Kims like Kim Deal, Kim Gordon, and Kim Thayil seemed to signal the primacy of the K Word. Kim was the kid with perpetual Christmas morning going on. The universe seemed to smile down on us as we made art and did what we pleased, as if to say, "Whatever, dude, I mean, Kim. It’s your day."

But what did we do with our Kimdate apart from starting clothing lines, burning out like a black hole sun, and simply keeping on? The moment passed, though it was still thrilling to finally talk to one of those crucial Ks — namely Deal, on the occasion of her surprisingly revitalized, multi-hued new Breeders album, Mountain Battles (4AD) and her forthcoming two-fer at Slim’s — and to dig her breed of Midwestern rock ‘n’ roll realness. I mean, would anyone concerned with conjuring cool or projecting power really say she was bummed out and rocking the chub duds when asked about her typical day?

"I think I’m actually a little depressed," said the sometime Pixies bassist in deliberate, Kim-to-Kim tones from Dayton, Ohio. "I’ve been sleeping in really late and I don’t know why. I gained weight — maybe because I quit smoking a year ago. I’ve gained weight, and you know, I feel fat. So that’s an odd feeling for me. I’m not very confident, and I feel kinda stupid, so I dress really bad and I just wear sweats. You know, when you’re looking good and feel good, you have a spring in your step, and then when you’re heavy for some reason, you’re just like, ‘Ah, lemme just get these sweats on and do what I have to do today.’"

Chin up, Kim — at least you have the Steve Albini-recorded Mountain Battles with insinuating, melancholy songs like the doo-wop-inflected "We’re Going to Rise" and the dreamily minimalist "Night of Joy." "Can’t stop the wave of sorrow," Deal coos in the latter alongside Deal’s twin sister Kelley, Jose Medeles, and Mando Lopez. "This night of joy follows — oh, everywhere you go." That and at least Deal has vaulted past her smoker days of getting winded after running up stairs. With the help of a prescription medication that altered her brain chemistry, she managed to kick the nic fits. "I felt a bit like a sociopath taking it for three months last year," Deal said. "Now it’s worn off and I’m just fat." She chuckled. "It’s better than being a skinny sociopath! There’s far too many of those wandering the streets right now."

But back to the average Deal day. Long after all our Kim Kristmases, Deal told me that when she isn’t touring or planning, say, the Breeders-curated May 2009 All Tomorrow’s Parties in England, she continues to spend her spare hours helping her father care for her mother, who has Alzheimer’s: "She’s doing pretty good. She knows who I am and stuff, but she can get on a loop and repeat some crazy shit! But it’s like, ‘OK, mom, whatever.’" So there is a morning after — full of earthy laughter straight from Planet Deal. *

Food + bikes = fun

Are you in search of good food? Are you on your bike when you’re looking for it? Do you want to join a bunch of other people on bikes chasing down good food? Food justice activist Antonio Roman-Alcala will be leading a bike tour this Sunday, Nov. 9, that sounds like part food education, part snacking, and a limited amount of pedal power (through the Mission and southeast parts of the city, which are blessedly flat.) The four-hour tour will feature guest speakers from Mission Pie, the Free Farm Stand, Veritable Vegetable, People’s Food System warehouse, and Community Alliance with Family Farms.

Space is limited to 40, with proceeds benefiting the “In Search of Good Food” movie project, a very cute pilot of which is posted above and features an inquiry into the origins of the vegetables in tacos served by El Toyanese truck on Harrison Street. A must, must see.

High speed rail coming to SF

Amid all the hoopla about last night’s big election, many people are overlooking another big win for San Francisco: the narrow approval of Prop. 1A, the $10 billion bond measure that is the first huge step to bringing high-speed trains into San Francisco. Just imagine walking, biking, or taking BART or Muni to the Transbay Terminal in downtown San Francisco, buying a $77 ticket, hopping on a sleek train that reaches up to 220 mph, and then arriving a Union Station in Los Angeles two and a half hours later.
In 10 years, you may not have to imagine it because it’ll be a reality. We’ll have more on this in the next couple days, including what those next steps will be and the status of a couple of lawsuits that challenging the project.

Transportation is the linchpin of sustainability. Fix the transportation system, and almost every other aspect of the city’s ecological health improves: public health, conservation of resources, climate change, economics, and maintaining our culture and sense of community.

The region’s unsustainable transportation system is the biggest cause of global warming (more than half the Bay Area’s greenhouse gas emissions come from vehicles) and one of the biggest recipients of taxpayer money. And right now, most of those public funds from the state and federal governments are going to expand and maintain freeway systems, a priority that exacerbates our problems and delays the inevitable day of reckoning.

It’s going to have to change — and we can do it the easy way or the hard way.

“We’ll get to a more sustainable transportation system. The question is, are we going to be smart enough to make quality of life for people high within that sustainable transportation system?” said Dave Snyder, who revived the San Francisco Bicycle Coalition and founded Transportation for a Livable City (now known as Livable City) before becoming transportation policy director for the San Francisco Planning and Urban Research Association. “People will drive less, but will they have dignified alternatives? That’s the question.”

That notion — that transportation sustainability is inevitable, but that it’ll be painful if we don’t start now in a deliberate way — was shared by all 10 transportation experts recently interviewed by the Guardian. And most agreed that needed reform involves shifting resources away from the automobile infrastructure, which is already crowding out more sustainable options and will gobble up an even bigger piece of the pie in the future if we continue to expand it.

“Yeah, it’ll be more sustainable, but will it be just? Will it be healthful? Will it be effective? Those are the questions,” said Tom Radulovich, director of Livable City and an elected member of the BART Board of Directors. “You can’t argue against geology. The planet is running out of oil. We’re going to have a more sustainable transportation system in the future. That’s a given. The question is, is it going to meet our other needs? Is it going to be what we need it to be?”

And the answer to all those questions is going to be no — as long as politicians choose to fund wasteful projects such as a fourth bore in the Caldecott Tunnel and transferring $4 billion from transit agencies to close California budget deficits accruing since 2000.

“Our leaders need to be putting our money where our collective mouth is and stop raiding these funds,” Carli Paine, transportation program director for Transportation and Land Use Coalition, told us. “I’m hopeful, but I think we all need to do more.”

 

TRANSIT AND BIKES

There is reason to be hopeful. With increased awareness of global warming and high gasoline prices, public transit ridership has increased significantly in the Bay Area. And one study indicates that the number of people bicycling in San Francisco has quadrupled in the last few years.

“Look at what’s happening on the streets of San Francisco: you have biking practically doubling every year without any new bike infrastructure. I think the demand is out there. The question is, when is the political leadership going to catch up to demand?” Jean Fraser, who sits on the SPUR and SFBC boards and until recently ran the San Francisco Health Plan under Mayor Gavin Newsom, told us.

But the political leadership and federal transportation spending priorities are behind the times. Of the $835 million in federal funds administered by the Metropolitan Transportation Commission for the nine Bay Area counties in 2006-07, 51.4 percent went to maintain and expand state highways. Only 2.5 percent went for expansion of public transit, and 2.4 percent for bike and pedestrian projects. Overall, Paine said, about 80 percent of all state and federal transportation funding goes to facilities for automobiles, leaving all modes of transportation to fight for the rest.

“Historically we favor the automobile at the expense of all those other modes,” Radulovich said at a forum of experts assembled by the Guardian (a recording of the discussion is available at sfbg.com). “It’s been given primacy, and I think everyone around this table is saying, in one way or another, that we need a more balanced approach. We need a more sustainable, sensible, and just way of allocating space on our roads.”

Yet the Bay Area is now locking in those wasteful patterns of the past with plans for about $6 billion in highway expansions, which means the MTC will have to spend even more every year keeping those roads in shape. Highway maintenance is the biggest line item in the MTC budget, at $275 million.

“We can’t pay for what we have now — to maintain it, repair it, seismically retrofit it — so why we’re building more is kind of beyond me,” Radulovich said. “We continue to invest in the wrong things.”

The experts also question big-ticket transit items such as the Central Subway project, a 1.7-mile link from SoMa to Chinatown that will cost an estimated $1.4 billion to build and about $4 million per year to run.

“There are 300 small capital projects we need to see,” Snyder said. “That’s really the answer. The idea of a few big capital projects as the answer to our problems is our problem. What we really need are 100 new bike lanes. We need 500 new bus bulbs. We need 300 new buses. It’s not the big sexy project, but 300 small projects.”

The most cost-efficient, environmentally effective transportation projects, according to renowned urban design thinkers such as Jan Gehl from Denmark, are those that encourage walking or riding a bike.

“I think Jan Gehl put it best, which is to say a city that is sweet to pedestrians and sweet to bicyclists is going to be a sustainable city,” Fraser said. “So I think focusing on those two particular modes of transportation meets the other goals of the financial viability because they’re the cheapest ways to get people around — and the healthiest ways — which I submit is one of the other criteria for sustainable transportation…. And it helps with the social justice and social connections.”

 

IT’S GOOD FOR YOU

In fact, transportation sustainability has far-reaching implications for communities such as San Francisco.

“I think of sustainability in two ways,” Fraser said. “The first is sustainability for the environment. And since I have a background in health care, I think of a sustainable transportation system as one that’s actually healthy for us. In the past at least 50 years, we’ve actually engineered any kind of active transportation — walking to work or to school, biking to school — out of our cities.”

But it can be engineered back into the system with land use policies that encourage more density around transit corridors and economic policies that promote the creation of neighborhood-serving commercial development.

“If my day-to-day needs can be met by walking, I don’t put pressure on the transportation system,” Manish Champsee, a Mission District resident who heads the group Walk SF, told us.

The transportation system can either promote that sense of community or it can detract from it. Champsee said San Francisco needs more traffic-calming measures, citing the 32 pedestrian deaths in San Francisco last year. Almost a third as many people are killed in car accidents as die from homicides in San Francisco — but murder gets more resources and attention.

“There’s a real sense in the neighborhoods that the roadways and streetscapes are not part of the neighborhood, they’re not even what links one neighborhood to another. They’re sort of this other system that cuts through neighborhoods,” said Gillian Gillette of the group CC Puede, which promotes safety improvements on Cesar Chavez Street.

Radulovich notes that streets are social spaces and that decisions about how to use public spaces are critical to achieving sustainability.

“A sustainable transportation system is one that allows you to connect to other people,” he said. “Cities have always thrived on connections between humans, and I think some of the transportation choices we’ve made, with reliance on the automobile, have begun to sever a lot of human connections. So you’ve got to think about whether it’s socially sustainable. Also economically sustainable, or fiscally sustainable, because we just can’t pay for what we have.”

So then what do we do? The first step will take place next year when Congress is scheduled to reauthorize federal transportation spending and policies, presenting an opportunity that only comes once every four years. Transportation advocates from around the country are already gearing up for the fight.

“We’ve built out the freeways. They’re connecting the cities — they’re pretty much done. So what do we need to do to make streets more vibrant and have more space for people and not just automobiles?” asked Jeff Wood, program associate for the nonprofit group Reconnecting America and the Center for Transit-Oriented Development.

Then, once communities such as San Francisco have more money and more flexibility on how to spend it, they can get to work on the other sustainability needs. “The key component is having all the transportation systems fully linked,” Paine said. That means coordinating the Bay Area’s 26 transit agencies; expanding on the new TransLink system to make buying tickets cheaper and easier; funding missing links such as connecting Caltrain from its terminus at King and Fourth streets to the new Transbay Terminal; and timing transfers so passengers aren’t wasting time waiting for connections.

And the one big-ticket transportation project supported by all the experts we consulted is high-speed rail, which goes before voters Nov. 4 as Proposition 1A. Not only is the project essential for facilitating trips between San Francisco and Los Angeles, it takes riders to the very core of the cities without their having to use roadways.

Paine also notes that the bond measure provides $995 million for regional rail improvements, with much of that going to the Bay Area. And that’s just the beginning of the resources that could be made available simply by flipping our transportation priorities and recognizing that the system needs to better accommodate all modes of getting around.

At the roundtable, I asked the group how much a reduction in automobile traffic we need to see in San Francisco 20 years from now to become sustainable — with safe streets for cyclists and pedestrians, free-flowing public transit, and vibrant public spaces. Sarah Sherburn-Zimmer, an organizer with SEIU Local 1021 and the Transit Not Traffic Coalition, said “half.” Nobody disagreed.

That may sound outrageous by today’s standards, when cars use about 30 percent of our roadways to handle about 5 percent of the people-moving (a similar ratio to how Americans constitute 5 percent of the world’s population but use more than 25 percent of the world’s resources). A sustainable, just, efficient mix would drastically beef up the operating budgets of Muni, BART, and other transit agencies, and transfer all the capital set aside for new freeways into new transit lines that would better serve, for example, the Sunset and Excelsior districts.

Alternative transportation advocates insist that they aren’t anti-car, and they say the automobile will continue to play a role in San Francisco’s transportation system. But the idea of sustainability means beefing up all the other, more efficient transportation options, so it becomes faster, cheaper, and easier to walk, bike, take transit, or rideshare (probably in that order of importance, based on the resources they consume). As Fraser said of residents choosing to drive cars, “We should make it so it’s their last choice.” *

 

Anniversary Issue: First, do no harm

Mayor Gavin Newsom announced last week that San Francisco is "on pace" to build a historic number of homes in a five-year period.

"Despite the housing crisis facing the nation, San Francisco is bucking the trends and creating a record number of homes," Newsom said. "Once again, San Francisco is leading the way."

But where?

Newsom notes that his housing-development plans will triple what San Francisco produced in the ’90s, and double the past decade’s housing production. He claims that he has increased the city’s production of affordable housing for low- and very-low-income households to the highest levels ever.

But he doesn’t point out that most people who work in San Francisco won’t be able to afford the 54,000 housing units coming down the planning pipeline.

The truth is that, under Newsom’s current plans, San Francisco is on pace to expand its role as Silicon Valley’s bedroom community, further displace its lower- and middle-income workers, and thereby increase the city’s carbon footprint. All in the supposed name of combating global warming.

So, what can we do to create a truly sustainable land-use plan for San Francisco?

<\!s> Vote Yes on Prop. B

In an Oct. 16 San Francisco Chronicle article, Newsom tried to criticize the Board of Supervisors for not redirecting more money to affordable housing, and for placing an affordable housing set-aside on the ballot.

"There’s nothing stopping the Board of Supervisors from redirecting money for more affordable housing," Newsom claimed. "Why didn’t they redirect money to affordable housing this year if they care so much about it?"

Ah, but they did. Newsom refused to spend the $33 million that a veto-proof majority of the Board appropriated for affordable housing last year. Which is why eight supervisors placed Prop. B, an annual budget allocation for the next 15 years, on the Nov. 2008 ballot.

<\!s> Radically redirect sprawl

The San Francisco Planning and Urban Research Association’s executive director, Gabriel Metcalf, notes that existing Northern California cities —San Francisco, Oakland, San Jose — already have street, sewer, and transit grids, and mixed-use development in place.

"So we don’t have to allow one more inch of suburban sprawl. We could channel 100 percent of regional growth into cities. Instead, we hold workshops and ask ‘How much growth can we accommodate? The answer is none, because no one likes to change."

Metcalf said he believes people should be able to work where they want, provided that it’s reachable by public transit.

"What’s wrong with taking BART to Oakland and Berkeley, or Caltrain to San Jose?" Metcalf said.

<\!s> Don’t do dumbass growth

Housing activist and Prop. B supporter Calvin Welch rails at what he describes as "the perversion of smart growth in local planning circles."

The essence of smart growth is that you cut down the distance between where people work and live, Welch explains.

"But that makes the assumption that the price of the housing you build along transit corridors is affordable to the workforce that you want to get onto public transit," Welch adds. "If it’s not, it’s unlikely they’ll get out of their cars. Worse, if you produce housing that is only affordable to the community that works in Silicon Valley, you create a big problem in reverse, a regional transit shortage. Because you are building housing for folks who work in a place that is not connected to San Francisco by public transit."

Welch says the city also needs to invest more in transit infrastructure.

Pointing to Market-Octavia and the Eastern Neighborhoods, Welch notes that while the City Planning Department is calling for increased density there, Muni is proposing service cuts.

"This is beyond bizarre," Welch said. "It will result in dramatic increases in density in areas that are poorly served by transit. That’s the dumbest kind of growth."

Welch says sustainable land use has local employment opportunities at its heart.

Noting that 70 percent of residents worked in San Francisco 20 years ago, Welch says that only a little over 50 percent of local jobs are held by San Franciscans today.

"Most local jobs are held by people who live outside San Francisco, and most San Franciscans have to go elsewhere to find work. It’s environmentally catastrophic."

<\!s> Protect endangered communities

Earlier this year, members of a mayoral task force reported that San Francisco is losing its black population faster than any other large US city. That decline will continue, the task force warned, unless immediate steps are taken.

Ironically, the task force’s findings weren’t made public until after voters green-lighted Lennar’s plan to develop 10,000 (predominantly luxury) units in Bayview-Hunters Point, one of the last African American communities in town.

San Francisco Redevelopment Agency Executive Director Fred Blackwell has since recommended expanding his agency’s certificate of preference program to give people displaced by redevelopment access to all of the city’s affordable housing programs, an idea that the Board of Supervisors gave its initial nod to in early October. But that’s just a Band-Aid.

And community leader and Nation of Islam Minister Christopher Muhammad has suggested creating "endangered community zones" — places where residents are protected from displacement — in Bayview-Hunters Point and the Western Addition.

"It’s revolutionary, but doable," Muhammad said at the out-migration task force hearing.

<\!s> Don’t build car-oriented developments

BART director and Livable City executive Tom Radulovich predicts a silver lining in the current economic crisis: "The city will probably lose Lennar."

He’s talking about two million square feet of office space and 6,000 square feet of retail space that Lennar Corp., the financially troubled developer, is proposing in Southeast San Francisco.

"We should not be building an automobile-oriented office park in the Bayview," Radulovich said. "Well-meaning folks in the Planning Department are saying we need walkable cities, but Michael Cohen in the Mayor’s Office is planning an Orange County-style sprawl that will undo any good we do elsewhere. This is the Jekyll and Hyde of city planning."

<\!s> Buy housing

Ted Gullicksen at the San Francisco Tenants Union says that since land in San Francisco only increases in value, the city should buy up apartment buildings and turn them into co-ops and land-trust housing.

"The city should try to get as much housing off-market as possible, grab it now, while it’s coming up for sale, especially foreclosed properties," Gullicksen said. "That’s way quicker than trying to build, which takes years. And by retaining ownership, the city also retains control over what happens to the land."

<\!s> Work with nonprofit developers

Gullicksen said that the city should work with small nonprofits, and not big master developers, to create interesting, diverse neighborhoods.

Local architect David Baker says nonprofits are more likely to build affordable housing than private developers, even when the city mandates that a certain percentage of new housing must be sold below market rate.

"Thanks to the market crash, very little market rate housing is going to be built in the next five years, which means almost no inclusionary," Baker explains. "During a housing boom, you can jack up that percentage rate to 15 percent, or 20 percent, but then the boom crashes, and nothing gets built."

Gullicksen says the good news is that planners are beginning to think about how to create walkable, vibrant, and safe cities.

"They are thinking about pedestrian-oriented entrances and transparent storefronts, about hiding parking and leaving no blank walls on ground floors. Corner stores, which are prohibited in most neighborhoods, are a great amenity.

"San Francisco needs to figure out where it can put housing without destroying existing neighborhoods, or encroaching on lands appropriate for jobs."

<\!s> Design whole neighborhoods

Jim Meko, chair of the SoMa Leadership Council, was part of a community planning task force for the Western SoMa neighborhood. He told us that one of the most important things his group did was think about development and preservation in a holistic way.

"WSOMA’s idea is to plan a whole neighborhood, rather than simply re-zoning an area, which is how the Eastern Neighborhoods plan started," Meko said. "Re-zoning translates into figuring out how many units you can build and how many jobs you will lose. That’s a failed approach. It’s not smart growth. If you displace jobs, the economic vitality goes elsewhere, and people have to leave their neighborhood to find parks, recreational facilities and schools."

Meko noted that "housing has become an international investment. It’s why people from all around the world are snapping up condos along the eastern waterfront. But they are not building a neighborhood."

San Francisco, Meko said, "has the worst record of any US city when it comes to setting aside space for jobs in the service and light industrial sector. But those are exactly the kinds of jobs we need. The Financial District needs people to clean their buildings, and I need people to repair my printing press. But I don’t like having to pay them $165 an hour travel time."

<\!s> Practice low-impact development

Baker recommends that the city stop allowing air-conditioned offices.

"We’ve got great weather, we need to retrofit buildings with openable windows," he said. "We should stop analyzing the environmental impact of our buildings based on national tables. This stops us from making more pedestrian friendly streets. And people should have to pay a carbon fee to build a parking space."

A citywide green building ordinance goes into effect Nov. 3 and new storm water provisions follow in January, according to the SFPUC’s Rosey Jencks.

This greening impetus comes in response to San Francisco’s uniquely inconvenient truth: surrounded by rising seas on three sides, the city has a combined sewer system. That means that the more we green our city, the more we slow down the rate at which runoff mixes with sewage, the more we reduce the risk of floods and overflows, and the more we reduce the rate at which we’ll have to pump SoMa, as rising seas threaten to inundate our sewage system.

The SFPUC also appears committed to replacing ten seismically challenged and stinky digesters at its southeast plant.

<\!s> Strictly control the type of new housing

Marc Salomon, who served with Meko on the task force, told us he thinks the city needs to create a "boom-proof" development plan, "a Prop. M for housing." That’s a reference to the landmark 1986 measure that strictly limited new commercial office development and forced developers to compete for permits by offering amenities to the city.

The city’s General Plan currently mandates that roughly two-thirds of all new housing be affordable — but the city’s nowhere near that goal. And building a city where the vast majority of the population is rich is almost the definition of unsustainability.

"Too much construction is not sustainable at any one time, nor is too much uniform development," Salomon said. "If we see too many banks, coffee shops or dot-com offices coming in, we need hearings. We need to adopt tools now, so can stop and get things under control next time one of these waves hits. And since infrastructure and city services are in the economic hole, we need to make sure that new development pays for itself." *

Lots of people opposed the creation of BART, but what would the Bay Area be if taxpayers groups and libertarians successfully derailed the campaign that created it in the 1960s?

That’s the same argument proponents give to Proposition 1A, which would build a high-speed train from San Francisco to Los Angeles, allowing riders to get from one end to the other for $55 in two and a half hours, after a nine-year construction period and the sale of nearly $10 billion in state bonds.

For the last 12 years this plan has had its caboose dragged all over the legislative map, and now that it’s on the ballot, it’s time to decide if California adopts a green transportation source that’s proven popular in Europe and Asia or whether its derailed by fears that it will strain taxpayers in the midst of a financial meltdown.

District 1

ERIC MAR


The incumbent District 1 supervisor, Jake McGoldrick, likes to joke that he holds his seat only because Eric Mar’s house burned down eight years ago. Back then Mar, who has had a stellar career on the school board, decided to wait before seeking higher office.

But now McGoldrick — overall a good supervisor who was wrong on a few key votes — is termed out, and progressive San Francisco is pretty much unanimous in supporting Mar as his successor.

Mar, a soft-spoken San Francisco State University teacher, was a strong critic of former school superintendent Arlene Ackerman and a leader in the battle to get the somewhat dictatorial and autocratic administrator out of the district. He’s been a key part of the progressive majority that’s made substantial progress in improving the San Francisco public schools.

He’s a perfect candidate for District 1. He has strong ties to the district and its heavily Asian population. He’s a sensible progressive with solid stands on the key issues and a proven ability to get things done. He supports the affordable housing measure, Proposition B; the Clean Energy Act, Proposition H; and the major new revenue measures. He’s sensitive to tenant issues, understands the need for a profound new approach to affordable housing, and wants to solve the city’s structural budget problems with new revenue, not just cuts.

His chief opponent, Sue Lee, who works for the Chamber of Commerce, doesn’t support Prop. H and won’t even commit to supporting district elections. She ducked a lot of our questions and was either intentionally vague or really has no idea what she would do as a supervisor. She’s no choice for the district, and we found no other credible candidates worthy of our endorsement. Vote for Eric Mar.

District 3

The danger in this district is Joe Alioto. He’s smooth, he’s slick, he’s well funded — and he would be a disaster for San Francisco. Make no mistake about it, Alioto is the candidate of downtown — and thanks to his famous name and wads of big-business cash, he’s a serious contender.

Two progressive candidates have a chance at winning this seat and keeping Alioto off the board. David Chiu is a member of the Small Business Commission (SBC) and the Democratic County Central Committee (DCCC) and is a former civil rights lawyer who now manages a company that sells campaign software. Denise McCarthy ran the Telegraph Hill Neighborhood Center for 25 years and spent 7 years on the Port Commission.

Tony Gantner, a retired lawyer, is also in the race, although he is running well behind the others in the polls.

We have concerns about all the candidates. Chiu has a solid progressive record as a commissioner and committee member: He was one of only two SBC members who supported the living-wage ordinance and Sup. Tom Ammiano’s city health care plan. He backed Sup. Aaron Peskin, his political mentor, for chair of the DCCC. He backs Prop. H, supports the two revenue measures and the affordable-housing fund, and wants to give local small businesses a leg up in winning city contracts. He has some creative ideas about housing, including a community stabilization fee on new development.

He’s also a partner in a company that received $143,000 last year from PG&E and that has worked with Republicans and some nasty business interests.

Chiu says he doesn’t get to call all the shots at Grassroots Enterprises, which he cofounded. He describes the firm as a software-licensing operation, which isn’t exactly true — the company’s own Web site brags about its ability to offer broad-based political consulting and communication services.

But Chiu vowed to resign from the company if elected, and given his strong record on progressive issues, we’re willing to take a chance on him.

McCarthy has a long history in the neighborhood, and we like her community perspective. She supports Prop. H and the affordable-housing measure. She’s a little weak on key issues like the city budget — she told us she "hadn’t been fully briefed," although the budget is a public document and the debate over closing a massive structural deficit ought to be a central part of any supervisorial campaign. And while she said there "have to be some new taxes," she was very vague on where new revenue would come from and what specifically she would be willing to cut. She supported Gavin Newsom for mayor in 2003 and told us she doesn’t think that was a bad decision. It was. But she has by far the strongest community ties of any candidate in District 3. She’s accessible (even listing her home phone number in her campaign material), and after her years on the Port Commission, she understands land-use issues.

Gantner has been a supporter of the Clean Energy Act from the start and showed up for the early organizing meetings. He has the support of the Sierra Club and San Francisco Tomorrow and talks a lot about neighborhood beatification. But we’re a little nervous about his law-and-order positions, particularly his desire to crack down on fairs and festivals and his strong insistence that club promoters are responsible for all the problems on the streets.

But in the end, Chiu, McCarthy, and Gantner are all acceptable candidates, and Joe Alioto is not. Fill your slate with these three.

District 4

DAVE FERGUSON


What a mess.

We acknowledge that this is one of the more conservative districts in the city. But the incumbent, Carmen Chu, and her main opponent, Ron Dudum, are terrible disappointments.

It’s possible to be a principled conservative in San Francisco and still win progressive respect. We often disagreed over the years with Quentin Kopp, the former supervisor, state senator, and judge, but we never doubted his independence, sincerity, or political skills. Sean Elsbernd, who represents District 7, is wrong on most of the key issues, but he presents intelligent arguments, is willing to listen, and isn’t simply a blind loyalist of the mayor.

Chu has none of those redeeming qualities. She ducks questions, waffles on issues, and shows that she’s willing to do whatever the powerful interests want. When PG&E needed a front person to carry the torch against the Clean Energy Act, Chu was all too willing: she gave the corrupt utility permission to use her name and face on campaign flyers, signed on to a statement written by PG&E’s political flak, and permanently disgraced herself. She says that most of the problems in the city budget should be addressed with cuts, particularly cuts in public health and public works, but she was unable to offer any specifics. She refused to support the measure increasing the transfer tax on property sales of more than $5 million, saying that she didn’t want to create "a disincentive to those sales taking place." We asked her if she had ever disagreed with Newsom, who appointed her, and she could point to only two examples: she opposed his efforts to limit cigarette sales in pharmacies, and she opposed Saturday road closures in Golden Gate Park. In other words, the only times she doesn’t march in lockstep with the mayor is when Newsom actually does something somewhat progressive. We can’t possibly endorse her.

Dudum, who ran a small business and tried for this office two years ago, continues to baffle us. He won’t take a position on anything. Actually, that’s not true — he’s opposed to the Clean Energy Act. Other than that, it’s impossible to figure out where he stands on anything or what he would do to address any of the city’s problems. (An example: When we asked him what to do about the illegal second units that have proliferated in the district, he said he’d solve the problem in two years. How? He couldn’t say.) We like Dudum’s small-business sentiments and his independence, but until he’s willing to take some stands and offer some solutions, we can’t support him.

Which leaves Dave Ferguson.

Ferguson is a public school teacher with little political experience. He’s a landlord, and not terribly good on tenant issues (he said he supported rent control when he was a renter, but now that he owns a four-unit building, he’s changed his mind). But he supports Prop. H, supports Prop. B, supports the revenue measures, and has a neighborhood sensibility. Ferguson is a long shot, but he’s the only candidate who made anything approaching a case for our endorsement.

District 5

ROSS MIRKARIMI


Mirkarimi won this seat four years ago after a heated race in a crowded field, and he’s quickly emerged as one of the city’s most promising progressive leaders. He understands that a district supervisor needs to take on tough citywide issues (he’s the lead author of the Clean Energy Act and won a surprisingly tough battle to ban plastic bags in big supermarkets) as well as dealing with neighborhood concerns. Mirkarimi helped soften a terrible plan for developing the old UC Extension site and fought hard to save John Swett School from closure.

But the area in which he’s most distinguished himself is preventing violent crime — something progressives have traditionally had trouble with. Four years ago, District 5 was plagued with terrible violence: murders took place with impunity, the police seemed unable to respond, and the African American community was both furious and terrified. Mirkarimi took the problem on with energy and creativity, demanding (and winning, despite mayoral vetoes) police foot patrols and community policing. Thanks to his leadership, violent crime is down significantly in the district — and the left in San Francisco has started to develop a progressive agenda for the crime problem.

He has no serious opposition, and richly deserves reelection.

District 7

SEAN ELSBERND


We rarely see eye to eye with the District 7 incumbent. He’s on the wrong side of most of the key votes on the board. He’s opposing the affordable housing measure, Prop. B. He’s opposed to the Clean Energy Act, Prop. H. It’s annoying to see someone who presents himself as a neighborhood supervisor siding with PG&E and downtown over and over again.

But Elsbernd is smart and consistent. He’s a fiscal conservative with enough integrity that he isn’t always a call-up vote for the mayor. He’s accessible to his constituents and willing to engage with people who disagree with him. The progressives on the board don’t like the way he votes — but they respect his intelligence and credibility.

Unlike many of the candidates this year, Elsbernd seems to understand the basic structural problem with the city budget, and he realizes that the deficit can’t be reduced just with spending cuts. He’s never going to be a progressive vote, but this conservative district could do worse.

District 9

3. MARK SANCHEZ


The race to succeed Tom Ammiano, who served this district with distinction and is now headed for the State Legislature, is a case study in the advantages of district elections and ranked-choice voting. Three strong progressive candidates are running, and the Mission–Bernal Heights area would be well served by any of them. So far, the candidates have behaved well, mostly talking about their own strengths and not trashing their opponents.

The choice was tough for us — we like David Campos, Eric Quezada, and Mark Sanchez, and we’d be pleased to see any of them in City Hall. It’s the kind of problem we wish other districts faced: District 9 will almost certainly wind up with one of these three stellar candidates. All three are Latinos with a strong commitment to immigrant rights. All three have strong ties to the neighborhoods. Two are openly gay, and one is a parent. All three have endorsements from strong progressive political leaders and groups. All three have significant political and policy experience and have proven themselves accessible and accountable.

And since it’s almost inconceivable that any of the three will collect more than half of the first-place votes, the second-place and third-place tallies will be critical.

Campos, a member of the Police Commission and former school district general counsel, arrived in the United States as an undocumented immigrant at 14. He made it to Stanford University and Harvard Law School and has worked as a deputy city attorney (who helped the city sue PG&E) and as a school district lawyer. He’s been a progressive on the Police Commission, pushing for better citizen oversight and professional police practices. To his credit, he’s stood up to (and often infuriated) the Police Officers’ Association, which is often a foe of reform.

Campos doesn’t have extensive background in land-use issues, but he has good instincts. He told us he’s convinced that developers can be forced to provide as much as 50 percent affordable housing, and he thinks the Eastern Neighborhoods Plan lacks adequate low-cost units. He supports the revenue measures on the ballot and wants to see big business paying a fair share of the tax burden. He argues persuasively that crime has to become a progressive issue, and focuses on root causes rather than punitive programs. Campos has shown political courage in key votes — he supported Theresa Sparks for Police Commission president, a move that caused Louise Renne, the other contender, to storm out of the room in a fit of cursing. He backed Aaron Peskin for Democratic Party chair despite immense pressure to go with his personal friend Scott Weiner. Ammiano argues that Campos has the right qualities to serve on the board — particularly the ability to get six votes for legislation — and we agree.

Eric Quezada has spent his entire adult life fighting gentrification and displacement in the Mission. He’s worked at nonprofit affordable-housing providers, currently runs a homeless program, and was a cofounder of the Mission Anti-Displacement Coalition. Although he’s never held public office, he has far more experience with the pivotal issues of housing and land use than the other two progressive candidates.

Quezada has the support of Sup. Chris Daly (although he doesn’t have Daly’s temper; he’s a soft-spoken person more prone to civil discussion than fiery rhetoric). If elected, he would carry on Daly’s tradition of using his office not just for legislation but also as an organizing center for progressive movements. He’s not as experienced in budget issues and was a little vague about how to solve the city’s structural deficit, but he would also make an excellent supervisor.

Mark Sanchez, the only Green Party member of the three, is a grade-school teacher who has done a tremendous job as president of the San Francisco school board. He’s helped turn that panel from a fractious and often paralyzed political mess into a strong, functioning operation that just hired a top-notch new superintendent. He vows to continue as an education advocate on the Board of Supervisors.

He told us he thinks he can be effective by building coalitions; he already has a good working relationship with Newsom. He’s managed a $500 million budget and has good ideas on both the revenue and the spending side — he thinks too much money goes to programs like golf courses, the symphony, and the opera, whose clients can afford to cover more of the cost themselves. He wants a downtown congestion fee and would turn Market Street into a pedestrian mall. Like Campos, he would need some education on land-use issues (and we’re distressed that he supports Newsom’s Community Justice Center), but he has all the right political instincts. He has the strong support of Sup. Ross Mirkarimi. We would be pleased to see him on the Board of Supervisors.

We’ve ranked our choices in the order we think best reflects the needs of the district and the city. But we also recognize that the progressive community is split here (SEIU Local 1021 endorsed all three, with no ranking), and we have nothing bad to say about any of these three contenders. The important thing is that one of them win; vote for Campos, Quezada, and Sanchez — in that order, or in whatever order makes sense for you. Just vote for all three.

District 11

1. JOHN AVALOS


2. RANDY KNOX


3. JULIO RAMOS


This is one of those swing districts where either a progressive or a moderate could win. The incumbent, Gerardo Sandoval, who had good moments and not-so-good moments but was generally in the progressive camp, is termed out and running for judge.

The strongest and best candidate to succeed him is John Avalos. There are two other credible contenders, Randy Knox and Julio Ramos — and one serious disaster, Ahsha Safai.

Avalos has a long history of public-interest work. He’s worked for Coleman Advocates for Children and Youth, for the Justice for Janitors campaign, and as an aide to Sup. Chris Daly. Since Daly has served on the Budget Committee, and at one point chaired it, Avalos has far more familiarity with the city budget than any of the other candidates. He understands that the city needs major structural reforms in how revenue is collected, and he’s full of new revenue ideas. Among other things, he suggests that the city work with San Mateo County to create a regional park district that could get state funds (and could turn McLaren Park into a destination spot).

He has a good perspective on crime (he supports community policing along with more police accountability) and wants to put resources into outreach for kids who are at risk for gang activity. He was the staff person who wrote Daly’s 2006 violence prevention plan. He wants to see more affordable housing and fewer luxury condos in the eastern neighborhoods and supports a congestion fee for downtown. With his experience both at City Hall and in community-based organizations, Avalos is the clear choice for this seat.

Randy Knox, a criminal defense lawyer and former member of the Board of Appeals, describes himself as "the other progressive candidate." He supports Prop. H and the affordable-housing fund. He links the crime problem to the fact that the police don’t have strong ties to the community, and wants to look for financial incentives to encourage cops to live in the city. He wants to roll back parking meter rates and reduce the cost of parking tickets in the neighborhoods, which is a populist stand — but that money goes to Muni, and he’s not sure how to replace it. He does support a downtown congestion fee.

Knox wasn’t exactly an anti-developer stalwart on the Board of Appeals, but we’ll endorse him in the second slot.

Julio Ramos has been one of the better members of a terrible community college board. He’s occasionally spoken up against corruption and has been mostly allied with the board’s progressive minority. He wants to build teacher and student housing on the reservoir adjacent to City College. He suggests that the city create mortgage assistance programs and help people who are facing foreclosure. He suggests raising the hotel tax to bring in more money. He supports public power and worked at the California Public Utilities Commission’s Division of Ratepayer Advocates, where he tangled with PG&E.

We’re backing three candidates in this district in part because it’s critical that Safai, the candidate of Mayor Newsom, downtown, and the landlords, doesn’t get elected. Safai (who refused to meet with our editorial board) is cynically using JROTC as a wedge against the progressives, even though the Board of Supervisors does not have, and will never have, a role in deciding the future of that program. He needs to be defeated, and the best way to do that is to vote for Avalos, Knox, and Ramos.

Two of the stalwart progressive leaders on the San Francisco School Board — Mark Sanchez and Eric Mar — are stepping down to run for supervisor. That’s a huge loss, since Mar and Sanchez were instrumental in getting rid of the autocratic Arlene Ackerman, replacing her with a strong new leader and ending years of acrimony on the board. The schools are improving dramatically — this year, for the first time in ages, enrollment in kindergarten actually went up. It’s important that the progressive policies Mar and Sanchez promoted continue.

Sandra Fewer is almost everyone’s first choice for the board. A parent who sent three kids to the San Francisco public schools, she’s done an almost unbelievable amount of volunteer work, serving as a PTA president for 12 terms. She currently works as education policy director at Coleman Advocates for Children and Youth. She knows the district, she knows the community, she’s full of energy and ideas, and she has the support of seven members of the Board of Supervisors and five of the seven current school board members.

Fewer supports the new superintendent and agrees that the public schools are getting better, but she’s not afraid to point out the problems and failures: She notes that other districts with less money are doing better. She wants to make the enrollment process more accessible to working parents and told us that race ought to be used as a factor in enrollment if that will help desegregate the schools and address the achievement gap. She’s against JROTC in the schools.

We’re a little concerned that Fewer talks about using district real estate as a revenue source — selling public property is always a bad idea. But she’s a great candidate and we’re happy to endorse her.

Norman Yee, the only incumbent we’re endorsing, has been something of a mediator and a calming influence on an often-contentious board. He helped push for the 2006 facilities bond and the parcel tax to improve teacher pay. He’s helped raise $1 million from foundations for prekindergarten programs. He suggests that the district take the radical (and probably necessary) step of suing the state to demand adequate funding for education. Although he was under considerable pressure to support JROTC, he stood with the progressives to end the military program. He deserves another term.

Barbara "Bobbi" Lopez got into the race late and has been playing catch-up. She’s missed some key endorsements and has problems with accessibility. But she impressed us with her energy and her work with low-income parents. A former legal support worker at La Raza Centro Legal, she’s now an organizer at the Tenderloin Housing Clinic, working with immigrant parents. She’s fought to get subsidized Muni fares for SFUSD students. Her focus is on parent involvement — and while everyone talks about bringing parents, particularly low-income and immigrant parents, more directly into the education process, Lopez has direct experience in the area.

Kimberly Wicoff has a Stanford MBA, and you can tell — she talks in a sort of business-speak with lots of reference to "outcomes." She has no kids. But she’s currently working with a nonprofit that helps low-income families in Visitacion Valley and Hunters Point, and we liked her clearheaded approach to the achievement gap. Wicoff is a fan of what she calls community schools; she thinks a "great school in every neighborhood" can go a long way to solving the lingering issues around the enrollment process. That’s a bit of an ambitious goal, and we’re concerned about any move toward neighborhood schools that leads to resegregation. But Wicoff, who has the support of both Mark Sanchez and Mayor Newsom, brings a fresh problem-solving approach that we found appealing. And unlike Newsom, she’s against JROTC.

Jill Wynns, who has been on the board since 1992, has had a distinguished career, and we will never forget her leadership in the battle against privatizing public schools. But she was a supporter of former superintendent Ackerman even when Ackerman was trampling on open-government laws and intimidating students, parents, and staff critics, and she supports JROTC. It’s time for some new blood.

Rachel Norton, a parent and an advocate for special-education kids, has run an appealing campaign, but her support for the save-JROTC ballot measure disqualified her for our endorsement.

As a footnote: H. Brown, a blogger who can be a bit politically unhinged, has no business on the school board and we’re not really sure why he’s running. But he offered an interesting idea that has some merit: he suggests that the city offer free Muni passes and free parking to anyone who will volunteer to mentor an at-risk SFUSD student. Why not?

Community College Board

There are four seats up for the seven-member panel that oversees the San Francisco Community College District, and we could only find three who merit endorsement. That’s a sad statement: City College is a local treasure, and it’s been badly run for years. The last chancellor, Phil Day, left under a cloud of corruption; under his administration, money was diverted from public coffers into a political campaign. The current board took bond money that the voters had earmarked for a performing arts center and shifted it to a gym — then found out that there wasn’t enough money in the operating budget to maintain the lavish facility. It’s a mess out there, and it needs to be cleaned up.

Fortunately, there are three strong candidates, and if they all win, the reformers will have a majority on the board.

Milton Marks is the only incumbent we’re supporting. He’s been one of the few board members willing to criticize the administration. He supports a sunshine policy for the district and believes the board needs to hold the chancellor accountable (that ought to be a basic principle of district governance, but at City College, it isn’t). He wants to push closer relations with the school board. He actually pays attention to the college budget and tries to make sure the money is spent the right way. He is pushing to reform the budget process to allow more openness and accountability.

Chris Jackson, a policy analyst at the San Francisco Labor Council, is full of energy and ideas. He wants to create an outreach center for City College at the public high schools. He also understands that the college district has done a terrible job working with neighborhoods and is calling for a comprehensive planning process. He understands the problems with the gym and the way the board shuffles money around, and he is committed to a more transparent budget process.

Jackson is also pushing to better use City College for workforce development, particularly in the biotech field, where a lot of the city’s new jobs will be created.

Jackson was president of the Associated Students at San Francisco State University, has been a member of the Youth Commission, and worked with Young Workers United on the city’s minimum-wage law. His experience, energy, and ideas make him an ideal candidate.

Bruce Wolfe attended City College after a workplace injury and served on the Associate Students Council. He knows both the good (City College has one of the best disability service programs in the state) and the bad (the school keeps issuing bonds to build facilities but doesn’t have the staff to keep them running). As a former member of the San Francisco Sunshine Ordinance Task Force, Wolfe is a strong advocate for open government, something desperately needed at the college district. He told us he thinks the college should agree to abide by the San Francisco Planning Code and is calling for a permanent inspector general to monitor administration practices and spending. He wants City College to start building housing for students. He has direct experience with the district and great ideas for improving it, and we’re happy to endorse him.

Incumbents Rodel Rodis and Natalie Berg are running for reelection; both have been a key part of the problem at City College, and we can’t endorse either of them. Steve Ngo, a civil rights lawyer, has the support of the Democratic Party, but we weren’t impressed by his candidacy. And he told us he opposes the Clean Energy Act.

Vote for Marks, Jackson, and Wolfe.

BART Board of Directors

With rising gasoline prices, congested roadways, and global warming, it’s now more important than ever to have an engaged and knowledgeable BART board that is willing to reform a system that effectively has San Francisco users subsidizing everyone else. That means developing a fare structure in which short trips within San Francisco or the East Bay urban centers are cheaper and longer trips are a bit more expensive. BART should also do away with free parking, which favors suburban drivers (who tend to be wealthier) over urban cyclists and pedestrians. San Francisco’s aging stations should then get the accessibility and amenity improvements they need—and at some point the board can even fund the late-night service that is long overdue. There are two candidates most capable of meeting these challenges:

District 7

LYNETTE SWEET


This district straddles San Francisco and the East Bay, and it’s crucial that San Francisco—which controls just three of the nine seats—retain its representative here. We would like to see Lynette Sweet more forcefully represent the interests of riders from San Francisco and support needed reforms such as civilian oversight of BART police. But she has a strong history of public service in San Francisco (having served on San Francisco’s taxi and redevelopment commissions before joining the BART board in 2003), and we’ll endorse her.

TOM RADULOVICH


Tom Radulovich is someone we’d love to clone and have run for every seat on the BART board, and perhaps every other transportation agency in the Bay Area. He’s smart and progressive, and he works hard to understand the complex problems facing our regional transportation system and then to develop and advocate for creative solutions. As executive director of the nonprofit Livable City, Radulovich is a leader of San Francisco’s alternative transportation brain trust, widely respected for walking the walk (and biking the bike—he doesn’t own a car) and setting an example for how to live and grow in the sustainable way this city and country needs.

P is for power grab

Mayor Gavin Newsom wants voters to believe that Proposition P, which seeks to change the size and composition of the San Francisco County Transportation Authority (TA) board, will lead to more efficiency and accountability.

But Prop. P’s many opponents — who include all 11 supervisors, all four state legislators from San Francisco, the San Francisco Planning and Urban Research Association, the Sierra Club, the San Francisco Bicycle Coalition, the San Francisco Democratic Party, and the Harvey Milk LGBT Democratic Club — say that the measure would hand over billions of taxpayer dollars to a group of political appointees, thereby removing critical and independent oversight of local transportation projects.

Currently, the Board of Supervisors serves as the governing body of the TA, a small but powerful voter-created authority that acts as a watchdog for the $80 million in local sales tax revenues annually earmarked for transportation projects and administers state and federal transportation funding for new projects.

As such, the TA holds considerable sway over the capital projects of the San Francisco Municipal Transportation Agency (MTA), which operates Muni and has a board composed entirely of mayoral appointees. Prop. P would give the mayor more control over all transportation funding, which critics say could be manipulated for political reasons.

As Assemblymember Mark Leno told the Guardian, "This is a system of checks and balances that seems to be working well." And, as Sen. Carole Migden put it, "if it ain’t broke, don’t mess with it."

But if Newsom gets his way and Prop. P passes, the TA’s board will shrink to five elected officials in February — and Newsom will be one of them.

TA executive director José Luis Moscovich told us it wouldn’t be a bad idea to have the mayor on the agency’s governing board. "But that’s different from taking the board from 11 to five members," Moscovich said. "And how would the districts be represented equally?"

Since the TA has only 30 staff members, compared with the MTA’s 6,000 employees, Moscovich finds it hard to see how overhauling his agency would result in greater efficiency.

"Our overhead is 50 percent less than the MTA’s," Moscovich said. "We are subject to all kinds of oversight. This is a sledgehammer to a problem that doesn’t require it."

Tom Radulovich, an elected BART board member and the director of the nonprofit Livable City, believes that personality and policy questions lie at the heart of Newsom’s unilateral decision to place Prop. P on the ballot.

"The mayor doesn’t get along with the Board of Supervisors," Radulovich told us. "The way things stand, the mayor effectively controls the MTA, and the board effectively controls the TA. The mayor would like not to have to deal with the board."

This isn’t the first time a merger has been suggested, and this isn’t even the first time it’s come up this year.

In February, MTA chief Nathaniel Ford suggested the merger, with the MTA in charge. At the time, Newsom was under intense scrutiny for dipping into a million dollars’ worth of MTA funds to pay his staffers’ salaries. He told the San Francisco Chronicle that taking over the TA was not his idea and not something his office planned to pursue.

But shortly after that, Sup. Jake McGoldrick tried and failed to qualify a measure that would have divided the power to nominate members of the MTA’s board between the mayor, the president of the Board of Supervisors, and the city controller.

Newsom retaliated with Prop. P, which would replace the TA board with the mayor, an elected official chosen by the mayor, the president of the Board of Supervisors, an elected official chosen by the board president, and the city treasurer.

While Newsom was honeymooning in Africa, mayoral spokesperson Nathan Ballard turned up the heat by criticizing the supervisors for spending TA funds on routine travel expenses and office supplies.

"I don’t understand why money that is supposed to go to roads is going to couches and cell phones for members of the Board of Supervisors," Ballard told the San Francisco Examiner. But according to public records, Newsom himself charged $14,555 in expenses to the TA while he was a supervisor and a TA board member, from 1997 through 2003.

Jim Sutton, an attorney who served as treasurer in both of Newsom’s mayoral campaigns, has formed a committee to support Prop. P, ironically called Follow the Money.

San Francisco Bicycle Coalition executive director Leah Shahum, whom Newsom appointed to, then fired from, the MTA board last year, said that the TA has a strong record, not only of tracking dollars and winning matching funds at the state and federal levels, but also of making sure that the needs of bicyclists and pedestrians are represented.

"The system we have now is also the most protective of our dollars," Shahum said, noting that the TA is stringent about recipient agencies’ meeting deadlines and keeping costs in check.

Moscovich warned that it’s important that the city quickly move on from the battle over Prop. P, in light of the ongoing financial meltdown on Wall Street and the federal government’s bailout plan.

"This financial tsunami that hasn’t hit us yet will make it harder to borrow money to complete engineering projects," Moscovich predicted. "So it’s important that we get beyond this and show a unified front, so that our credibility as a city is not in danger."
