If you’re one of those people who’s always on the lookout for the next big thing, and you think the next big thing might be tequila bars, you might feel a pang about Tres Agaves, the brick cathedral of tortillas, margaritas, and fun that opened about two and a half years ago in the ever-more-crowded environs of AT&T Park. Tequila is, at its best, a New World riposte to the single-malt scotches and fancy brandies of the Old World: a carefully made and indigenous essence worthy of thoughtful appreciation. Its source plant is the agave, a succulent that is often supposed to be a kind of cactus but is really a member (along with garlic and onions) of the lily family.
Tres Agaves does have a tequila tasting lounge, and maybe tequila geeks really can get some pondering done in there but maybe not. Tres Agaves isn’t about cozy spaces or nuanced discussions of a pedigreed drink; it’s a huge party full of sports whoops, big plates of likable food, and plenty of semiblitzed people. As parties go, it’s not bad at all. True, prices are on the high side; some of the dishes are ordinary; and most of the tequila goes into margaritas, which, for all their many innovations, are basically fruit drinks to get plastered with. But if, like me, you have a vestigial fondness for Chevy’s, Tres Agaves will seem pleasantly familiar.
The sense of déjà vu makes itself felt early, once you’re through the front door and past the host’s station, which is screened from the rest of the immense dining room by a half-wall that reminded me of an oversized ant farm, with stones instead of grains of sand (and, presumably, very large ants). The restaurant opens out around you like another country: a rolling plain of tables bounded by a line of booths, another dining area behind that, and, to the left, another province of tables. Far in the distance: a wall of exposed brick rises two stories high.
Now that the airlines have decided to start charging passengers for water, we must be extra grateful for those freebies that remain, such as chips and salsa in Mexican restaurants. Tres Agaves’ offering is especially good here: fresh, delicate, still-warm chips (as good as Chevy’s) along with two kinds of salsa, tomatillo and chipotle. The latter was deliciously smoky and bristling with chili heat but perhaps too salty. When we vacuumed up the first bowl of chips, another was swiftly brought, no questions asked.
Much of the food is exactly what you would expect to find in this kind of setting guacamole ($8), for instance, served in a pestle-like bowl and notable not only for its price but for a freshness that goes a long way toward justifying it. The guac was a wonderful bright green (avocado flesh begins to turn a gray-brown on exposure to air, so color is an important index of freshness) and carried a definite chili kick. Queso fundido ($9.50) a shallow bowl of melted white cheese suitable for scooping into warm corn tortillas or up with chips was dotted with chunks of pork rather than chorizo, and while I love chorizo (in both its Mexican and Spanish guises), it can be overbearing. The pork here was better-behaved.
At $19, a plate of chiles rellenos seems a little pricey, but at least you get two peppers (poblanos) big, fresh, and a vivid green stuffed with corn kernels, mushrooms, zucchini slivers, and melted white cheese. Like Newfoundland dogs, the poblanos look formidable but are quite mild-mannered (i.e., no discernable chili heat). They’re also charred and peeled, not batter-fried, which makes them less caloric and greasy-looking.
A few of the dishes were news to me. One, costillas ($9.75), consisted of pork knuckles braised in an ancho chile broth, and the result was something like a spicy osso buco. (The meat disappeared considerably faster than the broth, which we mopped up with a trayful of warm corn tortillas.)
Another, carne en su jugo ($17.50), turned out to be a kind of beef and bean stew traceable to the Mexican state of Jalisco (which is, not coincidentally, the heart of tequila country). The meat was obviously an obstinate cut that was going to require some serious tenderizing; it had been carved into ribbons, then simmered with red beans in a broth of lime juice, cilantro, and onions, almost like a cooked beef ceviche. The final product was puckeringly flavorful and nearly too salty I almost never say such a thing but was redeemed, in the end, by the acidity of the citrus.
A common experience in Mexican restaurants (at least for me) is to have done so much front-loading on chips, salsa, and the sundry delights known as antojitos at the beginning of the meal that, approaching the end, the mere thought of dessert becomes unbearable. Particularly if the dessert is flan, which it often is. Mexican flans aren’t bad, but I’ve never had one to compare with a good crème caramel or panna cotta. A simple solution to this problem, if it is a problem, is to offer something else, and Tres Agaves does, several times over.
Nonetheless, we didn’t quite warm to a chocolate-cinnamon cake ($6), despite its reasonable price and its attractive disk shape. The cake appeared with suspicious swiftness after we’d ordered it, leading us to suppose it had been sitting around for who knew how long, just dying to be summoned like an anxious junior-high-schooler at a dance. And it was dry from undue refrigeration? My kingdom for a flan! *
The syncopated sounds of the Fillmore Jazz Festival made their way through the huge crowd this 4th of July weekend. The fair-goers perused the many stalls lining Fillmore street, that were filled with vibrant art, jewelry and hats, some of which were directly influenced by the jazz theme that enveloped the weekends festivities. Kids ran around while saxophones blared from three different stages and adults threw back margaritas being sold by women with crazy glasses who were running stalls in front of local bars. Friendly, docile greyhounds were up for adoption (I so wanted to bring one home!), whose booth was conveniently located next to the bar-b-qued oyster and turkey leg stand, which I’m sure kept the dogs noses consistently pleased. The Fillmore District, famous for being a mecca for jazz music for many past decades, seems to be keeping the spirit of the music alive through this yearly event.
Del Martin and Phyllis Lyon have lived active lives — although “activist” would be the better word. One, the other, or both have been founding members of the Daughters of Bilitis, the Alice B. Toklas Democratic Club, the Council on Religion and the Homosexual, and Old Lesbians Organizing for Change. Martin, 87, was the first lesbian elected to a position in the National Organization for Women, where she was also the first to assert that lesbian issues are feminist issues. Lyon, 83, edited the Ladder, the first magazine in the United States devoted to lesbian issues. And together, it seems, there’s little they haven’t done, from coauthoring books to becoming the first gay couple in the nation to legally marry on Feb. 12, 2004, almost 50 years to the day they first became a couple.
Deemed void later that year, their marriage was reconstituted this June when the California Supreme Court ruled that same-sex marriage is, in fact, legal. Once again, Martin and Lyon were the first in line to tie the knot.
But gay marriage wasn’t the right they were fighting for when their relationship began back in 1954. “We had other, bigger issues. We didn’t have anything in the ’50s and ’60s,” Lyon recalls. “We were worried about getting a law passed to disallow people from getting fired or thrown out of their homes for being gay.”
Even something as simple as having a safe space to congregate was elusive. Before the mid-1950s, the only organizations that dealt with gay issues were run by and focused on men. So Martin and Lyon, along with a few other lesbian couples, founded the Daughters of Bilitis in 1955. “We would meet in homes, dance, and have drinks and so on, and not be subject to police raids, which were happening then in the gay and lesbian bars,” Lyon said. Those informal get-togethers eventually became the first lesbian organization with chapters nationwide.
They say their activism isn’t something that was sparked by their gender and sexuality, but came from being raised in politically conscious homes — Lyon in Tulsa, Okla., and Martin in San Francisco. When they met, working at the same company in Seattle, “both of us were already politically involved,” Lyon says.
“Really, ever since we were kids,” Martin adds. “You followed elections. You followed things like that. We wore buttons for Roosevelt. We couldn’t send money because we didn’t have any.”
“And then when we both moved in together, in San Francisco, the first thing we did was get involved with Adlai Stevenson,” Lyon says. They quickly got to know the major Democratic movers and shakers in the city, like the Burton family and later Nancy Pelosi, whom they would eventually turn to when there were gay issues that needed a push.
“We didn’t come out to everybody, but we came out to Nancy and the Burtons,” Lyon says.
These days age has tamped down the physically active part of their political activism, although they still donate money and were ardent Hillary Clinton supporters during this year’s Democratic primary race. They’re now backing Barack Obama over John McCain, though Martin expressed reservations. “I’m waiting to see how he handles the question about women and women’s rights. I’m not satisfied yet.”

Whether she’s demanding sit-down time with the mayor to discuss asbestos dust at Hunters Point Shipyard, offering to debate former 49ers president Carmen Policy over the need to develop 50 percent affordable housing in the Bayview, or doing the cha-cha slide on Third Street to publicize the grassroots Proposition F campaign, which fought the Lennar-financed multimillion-dollar Proposition G on the June ballot, Alicia Schwartz always bubbles with fierce enthusiasm.
“I absolutely love my job,” says Schwartz, who has been a community organizer with POWER (People Organized to Win Employment Rights) for four years.
Born and raised in Marin County, Schwartz graduated from the University of California, San Diego, with a degree in sociology and anthropology before returning to the Bay Area, where she is enrolled in San Francisco State University’s ethnic studies graduate program and works for the San Francisco–based POWER.
“It’s an amazing organization full of amazing people, united for a common vision, which is ending oppression and poverty for all,” says Schwartz. “In cities, the priorities are skewed to benefit folks who are wealthier and have more benefits. But the folks who keep the city running are not recognized or are suppressed.”
Prop. F wasn’t Schwartz’s first campaign experience. She had previously organized for reproductive justice, for access to health care and sexual-health education, and against the prison-industrial complex.
But it was the most inspirational campaign she’s seen so far.
“I saw the Bayview transformed,” Schwartz explains. “I saw people who’d lost faith in politicians come to the forefront and fight for the future. And I saw people across the city rallying in support, too.”
Schwartz acknowledges that Prop. F didn’t win numerically.
“But practically and morally, and in terms of a broader vision, Prop. F advanced the conversation about the future of San Francisco, about its working-class and black future,” Schwartz says. “Clearly, that fight isn’t over. It’s just beginning.”
Schwartz says she believes that the other success of Prop. F is that it raised the question of who runs our cities.
“And I think it was a huge victory, even being able to accomplish running a grassroots campaign, with no money whatsoever and where we had to up the ante, in terms of getting to know some of the political establishment.”
Most of all, Schwartz says she appreciated being able to work with people who hadn’t been part of POWER.
“And I appreciated being able to advance a set of demands that a broad range of people could support, while keeping the Bayview and its residents at the forefront,” she says.
While that particular campaign may be over, the battle for Bayview–Hunters Point continues on many fronts, says Schwartz.
“Are we going to allow it to be run by developers who don’t have our best interests at heart and who fool us with payouts and false promises?” she asks. “Are we going to allow San Francisco to become a place where people can’t afford to live, but surely have to come to work?”

It would be unfair to give any one person credit for stopping the state’s foolish plan to aerially spray synthetic pheromones to eradicate the light brown apple moth (LBAM). Thousands were involved in that struggle.
But there are at least three individuals we can think of who successfully fought the state with science, a tool that too often is used to dupe, not enlighten, the public.
They are James Carey, a University of California, Davis, entomology professor; Daniel Harder, botanist and executive director of the UC Santa Cruz Arboretum; and Jeff Rosendale, a grower and horticulturalist who runs a nursery in Soquel.
Together and separately, this trio used experience, field observation, and fact-finding tours to make the case that the California Department of Food and Agriculture (CDFA) would court disaster, in terms of lost time, money, and public goodwill, if it went ahead with the spraying.
And they did so at a time when UC, as an institution, remained silent on the matter.
“I felt like I needed to do this. No one was stepping up from a position of entomological knowledge,” says Carey, whose prior work on an advisory panel working with state agencies fighting the Mediterranean fruit fly between 1987 and 1994 led him to speak out when the state sprayed Monterey and Santa Cruz counties last fall.
Carey says the signatures of two UC Davis colleagues, Frank Zalom and Bruce Hammock, on a May 28 letter to the US Department of Agriculture also helped.
“All of us are senior and highly credentialed scientists,” Carey notes, “so our letter was taken really seriously by the agriculture industry.”
Rosendale and Harder had taken a fact-finding tour last December to New Zealand, which has harbored this leaf-rolling Australian bug for more than a century, to find out firsthand just how big of a problem the moth really is.
“We wanted to get the best information about how they were dealing with it, and what it was or wasn’t doing,” Rosendale recalls. What he and Harder discovered was that New Zealand had tried using organophosphates, toxic pesticides, against the moths — but the chemicals killed all insects in the orchards, including beneficial ones that stopped parasites.
“When they stopped using organophosphates, the food chain took care of the LBAM,” Rosendale says.
Like Carey and Rosendale, Harder believes that the state’s recently announced plan to use sterile moths instead of pesticides is a lost cause. He says it’s impossible to eradicate LBAM at this point because the pest is already too widespread.
“It’s not going to work, and it’s not necessary,” Harder says.
And now, Glen Chase, a professor of systems management specializing in environmental economics and statistics, says that the CDFA is falsely claiming that the moth is an emergency so it can steal hundreds of millions from taxpayer emergency funds.
“The widespread population of the moth in California and the specific population densities of the moth, when analyzed with real science and statistics, dictate that the moth has been in California for at least 30 to 50 years,” states Chase in a July 15 press release.
The state has put spraying urban areas on hold, but the battle isn’t over — and the scientists who have gone out on a limb to inform the public are still on the case.

Queer Youth Organizing Project

The queer-labor alliance Pride at Work, a constituent group of the AFL-CIO, added a youth brigade last year, and it’s been doing some of the most inspired organizing and advocacy in San Francisco. The Queer Youth Organizing Project can marshal dozens of teen and twentysomething activists with a strong sense of both style and social justice for its events and causes.
Founded in March 2007, QYOP has already made a big impact on San Francisco’s political scene, reviving the edgy and indignant struggle for liberation that had all but died out in the aging queer movement. Pride at Work has also been rejuvenated and challenged by QYOP’s youthful enthusiasm.
“It really is building the next generation of leaders in the queer community, and man, are they kick-ass,” says Robert Haaland, a key figure in both Service Employees International Union Local 1021 and Pride at Work. “Pride at Work is now a whole different organization.”
QYOP turned out hundreds of tenants for recent midday City Hall hearings looking at the hardball tactics of CitiApartments managers, an impressive feat that helped city officials and the general public gain a better understanding of the controversial landlord.
“They have a strong focus on tenant issues and have done good work on Prop. 98 and some tenant harassment legislation we’ve been working on,” says Ted Gullickson, director of the San Francisco Tenants Union. “They really round out the coalition between tenants and labor. They do awesome work.”
In addition to the energy and numbers QYOP brought to the campaign against the anti–rent control measure Prop. 98, the group joined the No Borders encampment at the Mexican border in support of immigrant rights and turned a protest against the Human Rights Campaign (which angered some local queers for supporting a workplace rights bill that excluded transgenders) into a combination of pointed protest and fun party outside the targeted group’s annual gala dinner.
“It’s probably some of the most interesting community organizing I’ve seen in San Francisco,” Haaland says. “It’s really made a difference in our capacity to do the work.”
As an added bonus in this essentially one-party town, QYOP is reaching young activists using mechanisms outside the traditional Democratic Party structures, an important feature for radicalized young people who are wary of partisan paradigms. And its members perhaps bring an even stronger political perspective than their Party brethren, circulating reading lists of inspiring thinkers to hone their messages.
Haaland says QYOP has reenergized him as an activist and organizer: “They’re teaching me, and it’s grounding me as an activist in a way I haven’t been for a long time.”
REVIEW This summer’s obligatory Will Smith blockbuster has the ever-bankable star playing the titular role in Hancock a foul-mouthed antihero apt to fly into action while clenching a bottle of whiskey. Though this reluctant superman of unclear origins consistently puts bad guys behind bars, the citizens of Los Angeles are none too thrilled when he arrives on the scene; Hancock’s chaotic brand of crime fighting has been taking a devastating toll on the city’s roads, buildings, ice cream trucks, and beached whales. That is, of course, until he saves the life of Ray (Jason Bateman), an idealistic public relations executive who decides to help Hancock revamp his image. Smith has the kind of charisma that can make even the most poorly-written shlock at least somewhat bearable. This time around, he doesn’t have to work as hard; Hancock is teeming with the fast-paced action and destruction that we seem to crave during the summer months. Plus, it’s surprisingly funny. As you might expect, Smith brings the bulk of the laughter but Bateman exceeds his straight-man role with his playfully wry delivery. Yes, the story is predictable and there is an annoyingly telegraphed "twist" involving Ray’s wife Mary (Charlize Theron), but Smith’s foray into superhero movies manages to entertain. For those keeping track, Hancock is no Men in Black (1997). Thankfully, though, it’s no Wild Wild West (1999) either.

Every couple has a different tale, and same-sex couples are no exception. Some met and fell in love at school; some found love in a bar.
Sarah Good and Kristina Ramos met in Charlottesville, VA, where Good was a law student and Ramos as a graduate student in English. They have been together 20 years, waiting for the right to marry.
So how did they know they were right for one another? “How does anyone know?” said Ramos. Good point.
Michael Gerber said he met husband Tony Paredes “after the bars on Folsom Street closed on a seedy Saturday night.”
“Oh don’t say that!” laughed Paredes, a burly bearded gentleman whose grey suit jacket matched Gerber’s.
For both couples, this day has been a long time coming. Gerber and Paredes have been together 13 years and were first married in 2004, mostly as an act of civil disobedience. Now they are marrying for a second time, and they hope it will be the last. “I’ve been out for a long time, and I never thought in my wildest dreams that this could really be happening,” said Gerber, beaming. “It’s very affirming, and it makes you feel good to have your marriage recognized by society,” he said.
While Good and Ramos recently took a three-week vacation to Australia, “as our retroactive honeymoon,” Gerber and Paredes will head off to Glacier National Park in Montana for two weeks. “We both enjoy road trips and we’ve been to many national parks,” said Gerber. “We’re from the City so we like to get out of Dodge as much as we can.” But don’t expect them to be pitching tents. Said Gerber, “my idea of camping is a room and a shower.”

Depaving Day opened the Towards Carfree Cities conference here in Portland yesterday. One might call it a soft opening, given today’s kickoff speakers, if not for the hard work involved. With pry bars and shovels they tore up the pre-sectioned asphalt, turning a paved lot along the Williams Avenue bike route in North Portland into the precursor of a community garden.
Why? Because “asphalt is ugly,” Cassandra Griffith with the nonprofit Depave.org told the crowd, most of whom had already signed the waivers to volunteer in the transformation. “Besides being ugly, it’s not super eco-friendly.”
Indeed, she said the soil, fruit trees, and cover crops to come will help absorb the stormwater for both that property and a few of its neighbors. This is the first project for this depaving group, a genre within the larger carfree community here in Portland, but Gritth said, “We want to do a few demonstration projects and then we want to encourage everyone to do it at home.”
One of the depaving workers who calls San Francisco “home,” architect David Baker, was bleeding from the shin but still hauling wheelbarrows full of busted pavement to the bin. “It’s a good thing to do and a great way to kickoff the conference,” he told me.
Later, he was part of the group that had lunch back at my place for the week, the White Eagle Café, Saloon, and Hotel, before taking off on an afternoon bicycle adventure that took us on a tour of more depaved spots – after tending to a bloody victim of clash between bicycling and Portland’s extensive rail system.
CHEAP EATS There is a kind of chocolate bar with bacon in it, so you know. There. You can go back to sleep now. You can believe in God again, or call and cancel your next 40 years of therapy, or board that airplane, or fall in love. I can’t do any of those things, yet, but you have my permission to go ahead without me. I’ll catch up.
First I’m going to sit here and work on my sweet tooth, which I’ve been trying to work on my whole female life. Before when I passed on dessert, opting instead for another helping of greens, it seemed kind of, I don’t know, cute almost or quirky. Judging from the looks on people’s faces now, for a woman to not like chocolate … that’s unseemly, grotesque, and just wrong.
Now, y’all know how I love to reinforce stereotypes …
Actually, I do. It’s fun! I mean, ideally I’d be in on the ground floor of the stereotype, like the one where transgender chicken farmers make better lovers. (Neil Young has a song coming out about that.)
All kidding aside, did I ever tell you what I tell people who tell me that "women don’t spit" or "ladies don’t use that word" or "girls don’t go around with a chicken in one hand and a hatchet in the other"? I tilt my head a little, bat my lashes, and go, "They do now, dear." Then I spit and say, "If you’ll kindly excuse me, I have to go chop this fucker’s head off."
But belligerence, like my pickup truck, only gets you so far. It doesn’t get you back to sleep at 3:30 a.m., or into heaven or off the couch or onto airplanes and into hearts. So I am willing to learn to like chocolate, same as I had to teach myself to like applesauce: by putting bacon in it.
Only this time I can’t take credit for the idea. That goes to Vosges Haut-Chocolat, purveyor of Mo’s Bacon Bar. Sockywonk and/or our friend Funiamorari bought me one while they were in New York and gave it to me for my birthday. There’s a picture on the box of a strip of bacon next to a square of chocolate, and a two-paragraph essay on the back by someone named Katrina, chronicling how she’s been working on the bacon + chocolate equation since she was six.
No mention of how old she is now, but since her grammar is pretty good and her spelling impeccable, and since she seems to own a chocolate company with retail stores in Chicago and New York, if I had to guess I’d say she’s at least seven.
My point being: come on! It took me one day to add up bacon + applesauce. Admittedly, it’s easier math. But 365 times easier? Well, six-year-old girls do sometimes have a hard time staying focused, unlike 45-year-old chicken farmers.
Where was I?
Thank you, Sockywonk! Thank you, Funiamorari! This isn’t the first time my wonderful, sisterly girlfriends have helped me become more stereotypical, and I’m sure it won’t be the last. Which is a subtle and complicated joke, but would be less so if we could include a group picture here of my wonderful, sisterly girlfriends.
I can’t express how much more confident I will feel now, on dates, when the waitperson asks if we would like dessert, and my date looks at me like, well? and instead of saying, "No, just another pork chop please," I can now say, "Oooh, do you have bacon chocolate bars?" Tilt of the head, bat of the lashes, and the deep-down knowledge that restaurants generally don’t serve candy bars. But at least it will seem like I have a sweet tooth. "I really shouldn’t," I will add, for effect, "but … "
They’re so good! Of course, of course they’d be even better if they were basically bacon with little flecks of milk chocolate in it, instead of the other way around. But my date doesn’t need to know every single silly thought flitting through my sweet mind.

My new favorite restaurant is Panda Country Kitchen. It’s also one of the windiest restaurants I’ve ever eaten at. Richmond District. I went there with the Maze on a foggy night, and we had tea-smoked duck and I forget what else. Oh, hot and sour soup, which was great, but it became cold and sour soup real fast. Turn the heat on!
The chain that owns SF Weekly, which last year had revenue of at least $159 million and more than $11 million in profit, argued in court June 5 that it’s having trouble raising money for an appeal bond to cover the $15.6 million judgment the Guardian won in its predatory pricing lawsuit.
SF Weekly attorney Rod Kerr asked Judge Marla Miller June 5 to stay the judgment until 10 days after she rules on post-trial motions. That could have delayed the judgment until July 28.
Village Voice Media, which owns the Weekly, needs to post a bond for the full amount of the verdict plus interest now accruing at more than $4,000 a day if the chain wants to avoid paying the Guardian during the appeals process.
Kerr argued that turmoil in the financial markets and the need for VVM to get approval from its lenders is making it difficult to secure the bond. "Without the post-trial decisions, they’re not willing to release the collateral," he said in court.
Kerr said he believes there is a likelihood the judgment amount will be substantially lowered during post-trial rulings, something the company has represented to its lenders.
Guardian attorney Ralph Alldredge, speaking to the court by telephone while his co-counsels Richard Hill and Craig Moody were present, reiterated a previous offer to stay enforcement until June 18, which is 30 days after the judgment was entered following the March jury verdict.
But Alldredge said the statements and briefs by the defendants raise serious concerns about whether they’re prepared to cover the full judgment, so the Guardian needs to be able to take steps to ensure that assets are being identified and secured to satisfy the judgment.
"They anticipate post-trial motions will result in a reduction of the verdict, so apparently their lenders have been told that," Alldredge said, adding, "The lenders need to be told the judgment is likely to be the final amount."
Judge Miller agreed with the Guardian position, granting the stay only until June 18, but allowing the defendants to return to court to ask for more time if they can provide evidence showing how it will result in a bond being issued.
"I am concerned there is a risk that the bond may never be issued," Miller said.
A San Francisco jury found that SF Weekly has been engaged in illegal predatory pricing going back to the mid-1990s, selling advertising below the costs needed to support the paper in an effort to drive the Guardian out of business.

Questions were raised in court yesterday about the ability of SF Weekly and their parent company, Village Voice Media, to pay the $15.6 million judgment that the Bay Guardian won in its predatory pricing lawsuit against the chain – or even to secure the bond needed to move forward with appeals.
Weekly attorney Rod Kerr argued the defendant’s motion for a stay of the judgment until 10 days after Judge Marla Miller rules on post-trial motions. Those motions are scheduled to be heard on July 8 and the judge has 10 days to rule, meaning the enforcement of the judgment could have been delayed until July 28.
Kerr argued that turmoil in the financial markets and the need for VVM to get approval from its lenders is making it difficult to secure the bond. “Without the post trial decisions, they’re not willing to release the collateral,” he said in court. “I think it’s a very reasonable request under the circumstances.”
Kerr said he believed there was a likelihood that the judgment amount would be substantially lowered during post-trial rulings, something that the company has also represented to its lenders. The difficulty in obtaining a bond for the full amount was also emphasized in a written declaration by SF Weekly’s chief financial officer, Jed Brunst.
Guardian attorney Ralph Alldredge, speaking to the court via telephone while his co-counsels Richard Hill and Craig Moody were present, reiterated a previous offer to stay enforcement until June 18, which is 30 days after the judgment was entered following the March jury verdict.
But Alldredge said the statements and briefs by the defendants raise serious concerns about whether they’re prepared to cover the full judgment, so the Guardian needs to be able to take steps to ensure that assets are being identified and secured to satisfy the judgment.
“They anticipate post trial motions will result in a reduction of the verdict, so apparently their lenders have been told that,” Alldredge said, adding, “The lenders need to be told the judgment is likely to be the final amount.”
The combination of problems securing a bond in the full amount and the defendant’s optimistic belief that they won’t have to pay the full $15.6 million raise concerns about whether the Guardian is going to get paid, he said.
“That’s a very shaky situation and it implies some risk that the bond may never be issued,” Alldredge said.
Hill also told the court that given the fact that Village Voice Media assets are spread across a number of states, it will be a long and difficult process for the Guardian to recover its judgment if VVM isn’t able to secure a bond and a long delay now would make that even more difficult.
Judge Miller agreed with the Guardian position, granting the stay only until June 18 but allowing the defendants to return to court to ask for more time if they can provide evidence showing how it will result in a bond being issued.
“I am concerned there is a risk that the bond may never be issued, based on the declaration of Mr. Brunst,” Miller said.

EDITORIAL If you think the June ballot was busy, wait until November. San Francisco will be electing six district supervisors. The mayor and organized labor are going to be pushing the mother of all bond acts, roughly $1 billion to rebuild San Francisco General Hospital. There’s likely to be a public power charter amendment mandating that the city mount a real effort to take over the electric grid. There will probably be a major affordable-housing initiative that includes a set-aside for low-income housing and perhaps some affordable-housing bond money. It’s shaping up as an election that will change the city’s direction for years to come but there’s still a crucial piece missing.
There’s no money.
Public power will, of course, generate vast amounts of new revenue, but not immediately: the process of setting up the system and fighting Pacific Gas and Electric Co. in court could drag out for several years. That, of course, is all the more reason to get started if the city had done this years ago, we wouldn’t have a budget crisis today.
But in the meantime, right now, San Francisco needs cash and there needs to be a November ballot measure that brings in new revenue to pay for more affordable housing and to save the services Mayor Gavin Newsom is cutting.
It’s tough to pass new taxes in California. Most of the time, state law mandates a two-thirds majority vote by the people to enact any new form of taxation. But it’s a bit easier when the supervisors are up for election; on those ballots, the threshold is only 50 percent. And with at least four tightly contested supervisorial races bringing out voters, labor bringing out the troops for the General Hospital bond, and the Democratic Party pushing to get voters out for Barack Obama, the turnout should be excellent.
So if there’s ever a good time to try to pass a tax measure, November 2008 ought to fit the bill.
All sorts of tax proposals have floated around City Hall in recent years and some of them for example, a higher real-estate transfer tax were defeated at the ballot. Some groups will oppose any tax proposal, and it’s hard to find constituencies that want to work hard for higher taxes.
So the key to crafting a revenue measure is to ensure that it’s as progressive as possible, and that it takes into account the concerns of those small businesses and homeowners who aren’t rich and can’t afford huge new levies. We see two good options:
1.A city income tax. This hasn’t been seriously discussed since the 1980s, but it ought to be. California law bars cities from collecting traditional income taxes that is, San Francisco can’t tax the incomes of everyone who lives here. But in 1978 the state Supreme Court ruled that cities can tax income earned from employment in the city. The upside is that a San Francisco employment income tax would hit commuters, a huge group who use city services and don’t pay for them. The downside is that people who live here but work, say, in Silicon Valley would escape the tax.
But overall, income taxes are the fairest method of collecting revenue, and a city tax could be set to hit hardest on the wealthiest. The city could exempt, say, the first $50,000 of earned income, levy a modest (say, 1 percent) tax on the next $50,000, then increase the marginal percentage so that people with enormous salaries pay as much as 2 or 3 percent.
The beauty of this: most of the people who paid the top-end income tax would simply write it off their federal income taxes meaning this would be a direct shift of cash from Washington DC to San Francisco. And it would come primarily from people who have already received a huge tax windfall from the Bush administration.
Yes, some people would cheat. Some businesses would try to claim their employees all really worked out of a satellite office in another city. But New York City has a municipal income tax. So does Philadelphia. They manage to deal with the cheaters. The supervisors at least ought to consider the idea.
2.A new business tax. Almost everyone agrees that San Francisco’s business taxes are unfair. The city places a flat tax on businesses a small merchant pays the same percentage as a giant corporation and some partnerships, like law firms, get away with paying no city taxes at all. The best way to fix that may be to create a single, progressive business tax (probably on gross receipts), with no loopholes, that exempts the first $100,000 or so and actually lowers the levy on small businesses while significantly raising it on big ones. Most small businesses would get an actual tax cut while the big guys would pick up the tab.
Together, a tax package like this could bring in the $250 million a year or so the city needs and some of the money could go to cutting, say, Muni fares or reducing the sales tax so working-class San Franciscans would pay less.
Almost everyone at City Hall knows the current tax system is unfair, regressive, and inadequate. We’ve been calling for the supervisors to do something about it for years now. November 2008 seems like an excellent time.
I push off and head down a makeshift plywood runway, compressing as I roll over the edge and into the Technicolor graffiti of the drainage ditch. The transition between the banked wall and the flatbottom has an abrupt kink in it, enough to send you to your face if you’re caught sleeping. I take some weight off the front end and try to maintain my speed as I pump into the opposite corner and carve the far end of the ditch where there’s an over-45-degree wall that runs behind what my friends and I call the "death pit" a gaping cutaway in the bottom of the culvert, five feet deep, filled with broken glass, and frequently used as a urinal. Since I’m at the apex of my backside carve, up a wall 10 feet above last week’s Miller Time, I’m jolted by the crackle of a loudspeaker:
"You are trespassing. Leave the area at once or you will be arrested."
My concentration shot by the sheriff’s announcement, I jump off my deck and over the chasm at the base of the bank, barely clearing the skater’s version of a Vietnam tiger pit, and land on the rough concrete beyond the edge. My board bullets straight in, though, so I’ve got to lower myself gingerly into the mostly dry detritus and rescue it before my friends and I jet out of the spot and into the manicured back nine of Pleasanton’s Castlewood golf course. We get to the car, throw the boards in the trunk mine has a "Skateboarding Is Not a Crime" sticker on the bottom and head to the next spot, a ditch called the Rat Trap.
The year is 1987. I’m 16, in high school, and living with my parents in Fremont. The scene plays out over and over in much the same way: a drainage ditch, a nicely painted curb or ledge at a shopping center, the occasional backyard pool, and night sessions at the Tar Banks, a set of embankments around a loading dock with curbs at the top. It’s an underground railroad of repurposed architecture, none of it designed with a skateboard in mind but all of it highly skateable.

Every weekend my crew hits as many spots as we can, and the constants shape up like this: urethane, aluminum, Canadian hard rock maple, concrete, and asphalt. Maybe blood, maybe beer we’re teenagers after all but nearly always: cops.
Skateboarding may not be a crime, but it sure as hell feels like one.
Flash forward 20 years. I’m with a different crew as I pull onto a street in suburban Redwood City, and I’m no longer rollin’ in my mom’s Plymouth Sundance, but my own truck. The other thing that’s changed is the number of wheels per head. There are four heads to eight wheels, and we’re here to ride the Phil Shao Memorial Skatepark. On bikes.
The park does not disappoint. There are a million kids trying tech ollie flip tricks around the perimeter of the park, but the bowl is what I’m about. Big and shapely with almost burlesque hips poured into her concrete, I’m in love as soon as I roll in. There are a few local bikers who have the place dialed, nonchalantly airing a few feet out and throwing the bars before heading back down the tranny. The only two skaters riding the bowl are a tall skinny teenager and his little sister, who looks to be about 10, and they have it on lockdown: lipslides on the spine, grinds, rock and rolls everything smooth and fast. "Yeah!" I yell as they take their runs, stoked on their skills.
I know the times have changed when I see the little girl come up out of the bowl in the $450,000 public piece of silky-smooth concrete perfection, walk over to her mother, who’s posted up on a ledge, get a cell phone and make a call. Not five minutes later there are seven (I counted) Redwood City police officers converging on the bench where my friends and I are sitting. They randomly collar my buddy Scott though I was the last one to drop in and write him a ticket for $100. I have to admit, I’m flabbergasted.
Guess what: skateboarding isn’t a crime anymore it’s gone mainstream. Successful companies hire lobbyists to promote the sport, and communities spend big bucks building new facilities for skaters. And now some skaters, many of them kids who never had to live in the underground world that I did, are using their legitimacy to push out the new outlaws people who ride BMX bikes.
It’s crazy two cultures that share so much, fighting over how many wheels they ride.
"Is that your daughter’s bike?"
The question comes from one of my coworkers, and, believe it or not, it’s not intended to be snarky. I can’t ride in public without someone saying "cute little bike," while giggling to themselves or laughing and pointing. Seeing a six-foot-tall, 200-pound, bald-headed, tattooed white dude on a "kid’s bike" is like being passed on the sidewalk by a bear on a unicycle. At one point reactions like these would’ve rubbed me the wrong way, but nowadays, I nod and smile. Sometimes, I try to explain what constitutes a "full grown" BMX bike. While it’s got small wheels 20 inches in diameter the top tube, from the seat to the stem, measures 21 inches, and the handlebars are considered pro-sized at eight inches high by 28 inches wide.
Bicycle motocross, or BMX, is purported to have started in 1963 when the Schwinn corporation of Chicago unveiled the Stingray, which was basically a downsized version of the company’s balloon-tired cruiser-type bikes. Kids pretended to be grown-ups by aping Roger DeCoster and other moto heroes launching their bikes off jumps, racing in empty fields and abandoned lots, and cranking wheelies down the sidewalks of Anytown, USA.
"It all began the way most individual sports start," motorcycle customizer Jesse James says in a voiceover at the beginning of the 2005 BMX nativity story/documentary Joe Kid on a Stingray, "kids pretending to be grown-ups, but acting like big kids."
I have been riding since I was seven. After three decades, one truism remains, and I can’t candy-coat it. I’ve got to speak it like a true BMXer: BMX is rad. It is and always has been an entity unto itself, progressing from wheelies, skids, and bombing hills to encompass myriad styles and surfaces, from streets to pools to dirt jumps to ramps to the balletic grace of flatland freestyle.
This summer, big kids on little bikes will be jumping 30-foot gaps at as many miles per hour as BMX pays homage to its racing roots at the 2008 Olympic Games in Beijing. On June 12 in New York’s Central Park, Kevin Robinson will try to break the legendary Mat Hoffman’s record for the highest quarter-pipe air on a bike 26 feet, 6 inches.
It doesn’t take death-defying world records, the X Games, the Olympics, or the stupefaction of squares with cameras to make BMX legit. That feeling of overcoming fear and doubt by jumping a little farther, a little higher, the rush of nailing a trick, or carving a bowl, hasn’t changed in half a century. The legitimacy lies in that feeling, behind your breastbone, and it doesn’t change as you get older. Your wrists hurt, your ankles hurt, and your back hurts, but the feeling is the same. Kid’s bike? Hell yeah, it’s a kid’s bike.
It’s not as though I was blissfully unaware of a beef between bikers and skaters that day in Redwood City. Ask any BMXer to tell you a story of friction between the two and four-wheeled sets, and it’s not going to take them long to come up with something.
"When I was 12 years old, a skateboarder threw my bike out of the bowl at Ripon skatepark," says Jackson Ratima, now 19, a Daly City rider sponsored by Fit Bikes. "He was, like, 20 years old or something."
Tim "Wolfman" Harvey, 21, another up-and-coming pro, tells a similar story about a visit to the Bay Area from his native Massachusetts, when a local skater hassled him at the Novato skatepark. "I didn’t even know anything about California. It was my first time out bike riding, period. The guy was giving me all kinds of crap, yelling at me."
Ironically, Harvey, as friendly and easygoing a guy as you could hope to meet, almost turned pro for skateboarding before an ankle injury made it nearly impossible to ollie, an essential trick in street skating. He now lives in Petaluma and is a member of the painter’s union in San Francisco, where he’s a familiar face at street spots, but now on a bike. Back then, though, he "thought California was a scary place."
The Bay Area and SF in particular may be the worst place for bikers seeking a vibe-free session. "I’ve never experienced hostility like it is out here," Ratima says.
Smoldering after the Redwood City incident, I began to fixate on the "Skateboarding Is Not a Crime" slogan from my youth. Originally a bumper sticker made by Transworld Skateboarding magazine in the mid ’80s, Santa Cruz Skateboards currently makes a deck with that written on it, so the skate community has gotten a lot of mileage out of being oppressed.
"Skateboarding isn’t a crime?" I’d ask myself. You’re damned straight skateboarding isn’t a crime: it’s the law. BMX is a crime. There isn’t a biker alive who rides transition who hasn’t rolled into a taxpayer-funded park and had a knee-high grommet point to the sign and say, "Bikes aren’t allowed."
Not allowed, huh? Son, I skated my first pool when you were doing the backstroke in your papa’s ball bag.
Look: I love skateboarding and always will. Both skaters and bikers are doing the same thing, copping that same feeling rolling over the same terrain. The war makes no sense.
"We have religion and race and class dividing us. I refuse to be divided by what type of wheel size I have," says Jon Paul Bail, a local at Alameda’s Cityview skatepark.
Bail, 40, is the artist and pundit behind politicalgridlock.com. Through the Home Project, a program run through the Alameda Unified School District, Bail helped raise $150,000 to build the park, $8,000 of which came directly from his company’s coffers. He helped design the park, and he helped pour the concrete in the park, which opened in 1999. Mixed sessions of bikers and skaters were going down for six months with minor tensions but no major incidents when thenCity Attorney Carol Korade advised City Hall that mixed use was too dangerous, and shut the bikers out.
My call to Corinne Centeno, Redwood City’s Director of Parks, Recreation, and Community Services, got off to a rough start: "I understand [the Phil Shao Skatepark] is not bike-legal, right?"
"Right. It was built as a skatepark," she replied, subtly italicizing the first syllable with her tone of voice.
"It wasn’t designed for bikes," she repeated, before adding, "but their having been prohibited from the start hasn’t necessarily kept people out." In an effort to do just that, the city is building a fence around the park, with bids currently ranging from $23,000 to $60,000.
The semantic argument "it’s called a ‘skatepark,’ not a ‘bike park’<0x2009>" is usually reserved for laypeople who don’t know enough about skateboarding or bike riding to see its inherent lack of logic.
Drainage ditches are not called a "skating ditches," nor were they designed for skating. Swimming pools are not called "skating pools." Yet, therein lie the roots of the modern skatepark, along with full pipes, which are based on industrial-size drainage systems also not intended for wheels. Every day skateboarders and bikers transcend these limits through creative repurposing.
Collision, and the fear of collision, is the main thing public officials cite when shutting bikers out of parks. "It’s unnerving," Vancouver pro skater Alex Chalmers wrote in a 2004 Thrasher manifesto, "BMX Jihad: Keep It in the Dirt."
"BMXers cover so much ground so quickly, especially when they’re pedaling frantically to blast a transfer, that it’s particularly hard to gauge these collisions," he wrote.
But the fact is that in any given park BMXers and skaters take different lines, and the best way to acclimate each group to the other is through exposure. If bike riders are banned, it increases the risk of collisions when a few bikers decide to chance the ticket or brave the vibe-out and ride anyway. A lot of bikers hit parks early in the morning because they don’t want to deal with hassles. During the overlap in "shifts," this leads to bewildered skaters who aren’t used to the lines a biker takes, and vice versa.
And the head-on menace is greatly overstated, largely disappearing when a park is integrated, if only unofficially. At Cityview, the police have displayed somewhat less zeal in ticketing bikers during the past few years. "They treat us like gays in the military," says Bail. "Don’t ask, don’t tell." And yet everyone manages to coexist.
At the new $850,000 skatepark in Benicia, which opened in October, integration isn’t a big deal. "From its conception, we designed it to be a skateboard park and also for bikes," says Mike Dotson, assistant director of parks and recreation. Technically, the park has designated bike hours, but since it’s largely unsupervised, there’s a mildly laissez-faire approach to enforcement. "In the very beginning there was a lot of concern about the use of both bikes and skateboards," Dotson says, stating that the park was packed the first few months. "Initially we had one or two calls on it. Since then I can say I haven’t had any calls on it in relation to bikes and skateboards being in it at the same time or other complaints."
And there are mixed-use parks all over the world, as far away as Thailand and as nearby as Oregon: "You go to Oregon, and you can ride wherever you want," says a stunned Maurice Meyer, 41, lifelong San Francisco resident and founding member of legendary bike and skate trick team the Curb Dogs. Long Beach, Las Vegas, Phoenix, even Alex Chalmers’ hometown of Vancouver all have parks where bikes and skates legally ride at the same time. What’s up with the Bay?
Lawyers, insurance underwriters, and city hall types may never understand how a park works. "It’s out of ignorance," Bail says. "To them it looks like chaos. To anyone who has skate etiquette which is everyone we all take turns."
Besides, let’s face facts: a skatepark is a dangerous place to different degrees at different times, and for different reasons. "I swear to God, every time I go to the skatepark I see a hundred boards flying all over the place," Ratima says, "and I’ve never seen a bike go flying and land on a guy’s head." It’s not an inflatable jumpy house it’s fun, but it’s not made out of cotton balls and your mother isn’t here. Usually.
Rose Dennis, press liaison for the San Francisco Recreation and Park Department, seemed baffled that someone would want to ride a bicycle inside the skatepark part of the new Potrero del Sol. Perhaps as a way of distracting me from my damn-fool idea, she kept hyping the park’s "other amenities."
I live three blocks from Golden Gate Park if I want to play Frisbee, I’m not going to drive across town. I want to ride. When I brought up the possibility of scheduling bike-only sessions in the yet-to-be opened park, she suggested I draft a letter to general manager Yomi Agunbiade, before adding that "the facility wasn’t designed for that type of recreation."
When I (graciously, I thought) let her know that it would be not only possible to ride a bike there, but highly gratifying, she got a little heated: "At the end of the day, the buck stops with us. If one of you guys breaks your skull open and you’re bleeding all over the place, believe me, no one’s going to have any sympathy for Rec and Park if they make really nonjudicious decisions."
In other words, like a lot of city officials, she’s worried about getting sued.
But you know what? There’s actually less chance a BMXer will successfully sue the city. I give you California Government Code Section 831.7, which states the following: "Neither a public entity nor a public employee is liable to any person who participates in a hazardous recreational activity … who knew or reasonably should have known that the hazardous recreational activity created a substantial risk of injury to himself or herself and was voluntarily in the place of risk."
The law lists "bicycle racing or jumping" as being a "hazardous recreational activity." It’s on a fairly extensive list, along with diving boards, horseback riding, and the ever-popular rocketeering, skydiving, and spelunking, which, as I’m sure you’ve heard, are all the rage with the kids these days much more popular than BMX.
But the words "skateboarding," "skateboarder," and "skateboard" are not listed anywhere in the text of the Hazardous Recreational Activities law, commonly called the HRA law. In fact, the International Association of Skateboard Companies has been lobbying to get the bill amended to specifically include "skateboarding" since 1995, when Assemblymember Bill Morrow (R-San Diego) took up the issue. Morrow’s bill was rejected by the state Senate Judiciary Committee in 1996. In 1997, Morrow and skateboard association lobbyist Jim Fitzpatrick gave up on amending the HRA and instead pushed Assembly Bill 1296, which added Provision 115800 to the state’s Health and Safety Code, which states, in part and in much less forceful language without using the word "liable," for instance that owners or operators of local skateparks that are not supervised must require skaters to wear helmets, elbow pads, and knee pads, and that they must post a sign stating said requirement.
It doesn’t say anything about "if one of you guys breaks your skull open and you’re bleeding all over the place" while wearing a helmet, then you can’t hold the operator liable.
When I asked San Francisco Deputy City Attorney Virginia Dario-Elizando how the law might apply to the city’s skateparks, she told me, "This question has never come up. I must tell you, I’ve never even seen the rules for the skateparks no one’s ever asked me to look at them."
BMXers are willing to compromise if that’s what it takes. In May, San Jose opened the 68,000-square-foot Lake Cunningham skatepark, built by the same design firm (Wormhoudt) as the Benicia park at a price of $4.7 million, and the place has bike hours. Like any park, there are rules. Like some parks, there’s supervision, so the rules are enforced: separate bike sessions; helmet, elbow, and knee pads required at all times; brakes required on bikes; no smoking; no songs with swear words over the park soundsystem; no bikes in the three bowls with pool coping even though they only allow plastic pegs, which are undoubtedly softer on coping than metal skateboard trucks … it’s a long list of restrictions. It’s inconvenient for guys who don’t like pads or don’t run brakes, and there’s some griping, but we’ve got our eyes on the prize: the place is amazing, with a huge full pipe, massive vert bowls, and a decent street course.
I would like skaters to realize a couple of things: skating and BMX aren’t so different from each other, at least in the feeling each gives you, right there, behind your sternum, where your heart beats.
Bikers are going to ride no matter what, just like skaters are going to skate. Legal or not, we’re not going to go away. "I got arrested for riding there when I was 14," Ratima says of the Daly City skatepark. "They took my bike and threw it in the back of the car. I just kept going every day, and finally they just gave up."
"I’ve ridden bikes on vert," Thrasher editor Jake Phelps tells me during a phone conversation. "I can ride a bike in a pool, I can do that. I’m stoked when I ride a bike in a pool. Feels hella fun to me. Catching air on a bike is awesome, no doubt about that."
This, from the longtime editor of the bible of the "fuck BMX" set. It’s either baffling or heartening. I can’t decide which. "I don’t mind people that are just regular," he says. "If they’re skateboard people or they’re bike people too, I’ll respect anybody that respects me."
That’s what it comes down to: respect. I respect the fact that skateboarders did not come into this age of skateparks easily. I faded out when there was nothing, and I came back when they were in small towns across America, and I missed all the politicos and dreary meetings. It’s time for bikers to stop feeling like second-class citizens and demand a seat at the table. In the words of Black Flag, it’s time to rise above.
PREVIEW When the Long Blondes arrived in November 2006 in fits of preening twirls and smoldering pouts with the decadent disco/new wave revamps of Someone to Drive You Home (Rough Trade), we’d at last found worthy successors to Pulp’s lip-gloss-and-sweatsmeared velvet crown. Fronted by the risky, romantic Kate Jackson, the Sheffield, England, quintet proved to be just as adept at intertwining the tawdry with the chic as their hometown forerunners, delivering laser-precise details of the dating scene while making the blood rush with every dirty dalliance and morning-after sound. Amid the snappy glam guitars, ice-sparkling synths, and jitter-pop rhythms, Jackson peered into the dance floors and singles bars and narrated back with a furious mix of exhilaration, lasciviousness, and cool detachment. Love’s a dangerous game with the Long Blondes, but pity the poor fool who doesn’t join in the frantic romp. When they sang promises of "Giddy Stratospheres" on the disc’s unstoppable Blondie-esque highlight, who could deny themselves such steamy, limb-tingling rapture?
Having recently re-emerged with the darker, rougher-edged Couples (Rough Trade), the Long Blondes remain just as committed to the hot-‘n’-flustered/couldn’t-be-bothered dynamic as they were before, and the Pulp/Blondie parallels hold true as well. On this go-round, however, there’s more menace to their nightclub trawling. Tracks such as "Round The Hairpin" skulk and creep with post-punk hypnotics recalling the likes of the Au Pairs, while the skeletal throb of "Too Clever By Half" offers spooky minimalist-disco deserving of the Italians Do It Better label. But for all their newfound experimentalism, the group has kept its flair for penning liberating live-wire pop anthems firmly tucked in its front pockets. "Falling in love is hard," Jackson reveals on "The Couples." "Writing a love song is even harder." Perhaps, but the Long Blondes have the lust-song thing down.

Earlier this spring, a young colleague wrote to ask if I knew of seafood restaurants in the city that emphasize sustainability. While I could recall plenty of sightings of sustainable seafood items on various menus in recent years, I could only think of two seafood restaurants that answered to his description places, in other words, where sustainability is central to the restaurant’s consciousness and is a basic element of menu composition. One is the Hayes Street Grill, whose menu card gives detailed information about where and how particular fish have been taken. The other is a small sushi spot named Tataki that opened about three months ago in an old Subway space at the southern foot of Pacific Heights.
Tataki does and doesn’t look like a typical sushi spot. It does have a small bar in a far corner of the snug dining room where you can sit on ergonomically peculiar stools of black plastic and watch the chefs deftly go about their business, and the bamboo tables were handmade by owners Raymond Ho and Kin Lui. But the pumpkin-colored walls are unusual, and the slate floor, while handsome, does contribute to a noise level that can be surprisingly high for such tight quarters. Of course, nowhere is it written that sushi bars and other Japanese restaurants must be quiet and serene; here it is merely written that, so far as this writer is concerned, it’s nice when they are.
Still, as holes-in-the-wall go, Tataki isn’t bad looking. The real interest lies in the menu. To a glance, this document resembles many others around town: there are selections of nigiri, rolls, tataki, soups, salads, and starters from the grill. But, as at HSG, each menu entry includes information on how the fish were obtained. Many are farmed, and while aquaculture raises all kinds of uncomfortable issues about pollution, antibiotics, and food-chain inefficiency, it does offer one inarguable virtue: aquaculture helps protect wild fish populations from collapse.
Since salmon, whether farmed or wild, is problematic now, Tataki uses a close relation, farmed arctic char, instead. The fish, with its delicate rose-peach flesh, makes a handsome nigiri ($4.50); it also turns up in one of the rolls and as carpaccio. Other nigiri might feature hiramasa ($4.50), also known as kingfish (a yellowfin relative, farmed in Australasia), and California striped bass ($4.50), whose flesh is like a disk of translucent ivory someone spilled Grenache on.
No sushi joint in San Francisco would be complete without a clutch of wittily named rolls to call its own, and Tataki is no exception. The best name probably belongs to the Divisaderoli ($6), chunks of avocado bundled with either tuna or kampachi (a Hawaiian member of the jack family) and scattered with glistening orange grains of tobiko. Tastier, if bearing a less-fun-to-pronounce name, is the Mix It Up roll ($11), a blend of spicy tuna and crab meat that achieves an almost sausage-like intensity of flavor and texture.
But the king of Tataki’s rolls is surely the Extinguisher ($13), which offers not only a serious spice kick but a moment of real visual spectacle. If you like saganaki (the flaming cheese of Greece), you’ll love this scene. But first, the roll itself: flaps of kampachi marinated with chiles, packed in rice, topped with chunks of avocado, squirts of what the menu calls "hot sauce" (chipotle mayonnaise?), and heavy sprinklings of habañero tobiko, fire-alarm red rather than the usual orange. The redness of the tobiko should be enough to caution anyone who’s remotely paying attention, but just to make sure, the chef sprinkles the side of the platter with rock salt, sloshes some rum over the crystals, and lights the whole thing on fire with a blowtorch. This might make an interesting DIY project for the patronage, assuming no licensure issues probably a large assumption.
The flame, which is mostly blue and not at all raging (its more like something you’d see under a chafing dish), burns down quickly, and you might not even notice it expire, since eating the actual roll is a memorable experience of fire and spice. I love spicy food and I responded to the clever combinations here, but at the same time it did seem to me that the subtleties of the fish were all but irrelevant. Nuance can get lost in firestorms.
A nice chaser to the Extinguisher would be the cold spinach ($4), with the greens "boiled … in soy broth," as the menu grimly explains. The dish sounded almost Dickensian in its bleakness, but it turned out to be four compressed-spinach cylinders cut on the bias and arrayed upright on a plate, like a little diorama of some ancient temple. (Minor complaint: the tightly packed leaves were tricky to hack through.) A more easygoing cold dish the Sancho Panza of such dishes in Japanese restaurants is the seaweed salad ($4), which Tataki, in a nice twist, presents in a large porcelain ladle.
Despite mounting evidence that fisheries are collapsing from human exploitation throughout the world the plight of the king salmon is a recent, local, and particularly disturbing example; see also the death of the Grand Banks off Newfoundland we seem to have a vestigial confidence that the oceans are too vast to suffer real harm at our hands. If we don’t see it happening, then it can’t be quite real. But it is happening and it is real, and if there is going to be any kind of future for sushi and other seafood restaurants, it will be because Tataki, in its eco-prescience, turned out to be the dawn of a new day. *
GREEN CITY From inside the trailer-size office at Sunrise Farms, one can hear the incessant squawking of 160,000 chickens housed nearby. The Petaluma-based egg producer generates the vast majority of eggs sold in the Bay Area with its seven properties and 1 million hens, one of two large egg operations in a region that used to have thousands of smaller chicken farms.
On one wall of the office a framed aerial black-and-white photograph shows the same property as it appeared more than 70 years ago. The layout of buildings hasn’t changed much over time, still retaining the long, thin structures aligned side-by-side. But in the photograph, little white specks populate the space between buildings they’re chickens, and all 10,000 were free to wander. Today the birds are kept indoors and, to save space and increase production, are typically confined in small cages. These "battery" cages are stacked in rows four cages high, allowing each bird 67 square inches of room about the size of a large shoebox.
Although the egg industry says the cage systems are science-based and humane, animal welfare activists say they are cruel and restrict natural behaviors. In November, voters will decide whether to ban the cages in California, thanks to a six-month signature-gathering effort sponsored by the Humane Society of the United States along with other animal welfare groups. As hundreds of veterinarians, businesses, farmers, and politicians including Assembly member Mark Leno and state senator Carole Migden continue to endorse the measure, the California egg industry is rallying farmers from across the country against it. If voters approve the law, California’s egg farmers would be required to move the state’s 19 million caged birds into cage-free facilities by 2015.
Since 2002, Florida, Arizona, Oregon, and Colorado have passed similar laws regarding the confinement of pregnant pigs and veal calves in crates both included in the California measure but California would be the first state to pass a law regarding the confinement of egg-laying hens. The pork and veal industries have begun voluntarily phasing out confinement practices nationally, and animal welfare groups hope for a similar response from the egg industry if the measure passes in California.
But some consumer groups and egg producers fear the cost of eggs could increase drastically as a result of the new laws. The industry is historically volatile, with prices rising and falling week to week due to disease outbreaks and fluctuating consumer demand. Recently, however, the industry has seen steady growth. The average American now buys around 260 eggs per year, an increase since the 1990s that has resulted in higher profits for the $3 billion-a-year industry.
Although the financial toll the measure would have on farmers and consumers is unclear, the Humane Society touts a study prepared for an industrywide meeting in 2006 as evidence that the cost to switch over to cage-free farming would be minimal. The report claims that the difference between constructing and operating a cage-free facility compared to a caged one amounts to less than one cent per egg. However, the work-up assumes land prices of $10,000 per acre a fourth of the average land cost in Sonoma County. But even using the higher estimate, the difference is still only slightly more than a penny per egg.
Arnie Riebli, the managing owner of Sunrise Farms, says he disagrees with those figures and doesn’t understand how they were calculated. Indeed, he thinks the cost of cage-free production is closer to double that of caged production. Even so, he says that while initial costs are higher, he receives a higher profit margin on cage-free eggs because of their specialty pricing.
If required to raise only cage-free birds, Riebli says his business will lose its competitive edge to out-of-state producers. One-third of California’s eggs currently come from outside of the state, which means the delivery routes and trucks from the Midwest are established, which means flow could easily be increased. "Every other state is going to sit out there and ship more eggs in here," he says. "They’re not stopping it. They’re just moving it somewhere else."
Riebli’s says he is concerned with his hens’ welfare as much as ever, and has taken trips across the world to research the latest in hen-raising technology. But he stands by his methods. "I use myself as a judge to see what my animals will like," he says. "I go into the building just as I am. If I’m comfortable without a mask, without any protection, then the birds must be too."
The chickens closest to the office are considered cage-free. The 4,000 birds inside the building are fed an all-organic diet and, although quarters are still tight (slightly over a square foot is allotted for each), the birds can dust bathe, perch on posts, and spread their wings. Sunrise Farms reflects the entire industry, since only about 5 percent of its egg-laying hens are raised without cages. In most other buildings, birds are held in battery cages. Ten birds live in each four-foot metal cage.
The eggs are packed on site and distributed through NuCal Foods, the largest egg supplier in the western United States. NuCal also delivers eggs from Gemperle Enterprises, the company whose facility recently came under fire after animal rights activists released undercover footage of severe animal abuse at its farm. Although the farm now claims the video was staged, it showed heinous acts of cruelty, including stomping and throwing hens. More important, it showed the conditions of the hens living in battery cages. Many had excessive feather loss, abnormal growths, and infections.
Riebli says he wants to distance his farm from the cruel treatment shown in the video. Still, he admits that all laying hens are susceptible to cancers, infections, and feather loss, although not usually as severe as what was shown in the video. "There’s a disconnect to where people’s food comes from," Riebli says. "They think it comes from the back of the grocery store, but unfortunately it doesn’t. It has to come from somewhere."
The Riebli family has been in the Petaluma egg business for more than 100 years, and since 1960 his company has grown by joining with other egg producers. The farm survived the Depression, the bird-flu scare, many salmonella outbreaks, and even break-in attempts from animal rights activists. Now that iron bars guard the office windows, Riebli is no longer as worried about criminal attempts against his farm. His main concern these days is that the law, although aimed at protecting chickens, could put him out of business.
"Animals are not human," he says, furrowing his brow and raising his voice slightly. "They don’t have intellect. Chickens probably have brains the size of a pea."
Sara Shields, who holds a doctorate in animal behavior from the University of California, Davis, is among the most vocal American scientists to oppose the use of battery cages. She notes that in Europe, where battery cages were banned in 1999, she’d be considered moderate. She recently released an extensive study comparing the welfare of hens in battery cages to those in cage-free systems. "I would like to see us raise the bar for the treatment of animals," she says. "There’s a limit to how high that bar can be set in cages. I don’t think cages have the potential to be humane."
But most American agricultural scientists disagree and say both systems can be operated humanely, though they grant that poorly-run versions of either type can be disastrous. To prevent mismanagement, United Egg Producers, a lobbying group that represents 85 percent of the country’s egg farms, decided to develop standards for caged production in 1999. They sought out UC Davis poultry scientist Joy Mench to lead a team of scientists in creating these welfare guidelines.
By analyzing the disease, injury, mortality, and productivity rates of birds kept in different systems and spaces, the group developed criteria that the industry subsequently adopted. Among these standards is the 67-square-inch minimum space requirement for each hen. These measures mostly focus on disease and mortality control as well as egg-laying productivity, but have less concern for behavioral welfare.
Although caged birds in modern systems sometimes have lower disease rates than cage-free birds, Shields says the potential for humane treatment in cage-free systems is much higher. Most scientists agree that hens in battery cages cannot engage in many of their natural behaviors, including wing-flapping, nest-building, perching, dust-bathing, scratching, and preening. And although disease control in cage-free systems is more difficult, Shields says, cage-free flocks can be maintained healthfully and successfully.
But Riebli has had problems with one of his younger cage-free flocks at Sunrise Farms. They became startled and piled on top of each other earlier this month, he says, suffocating 20 percent of the birds.
But Shields says this is highly unusual, and points toward newer, aviary-style cage-free systems as a solution for producers who encounter the problem. These methods divide the birds into smaller flocks within the same building, and rely on multiple levels to allow birds to perch and nest. Another potential issue, she says, is the lack of a perfectly-bred hen for cage-free production. After years of breeding hens to produce well in battery cages, breeders only recently have begun breeding for traits that benefit cage-free production. "The bird needs to be suited to the environment, and the environment also needs to be more suited to the birds," she says.
An aviary system costs more to set up than an empty cage-free building, but Shields dismisses these costs. "If we keep racing to the bottom in the name of cheap food, the eventual cost is going to be put on the animals," Shields says. "At some point we have to balance economic costs with moral and ethical considerations."
Over the past two-and-a-half years, a group of 15 politicians, scientists, farmers, and ranchers banded together to do just that. The Pew Commission on Industrial Farm Animal Production released a report last month detailing many troubling issues with the country’s farm animal production. The group specifies that the California ballot measure is a great place to start.
More than 100 cows graze Bill Niman’s 1,000-acre Marin County ranch, but only a couple have ever successfully navigated down the cliffs from the pastures to the beaches. Niman’s home is less than a mile inland, and on clear days he can see across the bay to San Francisco and even Daly City. He founded Niman Ranch on this property in the early 1970s and quickly caused a stir by deciding not to feed antibiotics and hormones to his cows. At first his fellow ranchers didn’t take him seriously, but now nearly all beef producers feed their cattle hormone-free food. More than 30 years later, Niman is determined to use the credibility he has earned to help all farm animals gain better treatment.
Last year, at 63, he gave up his seat on Niman Ranch’s board of directors, effectively ending his involvement with the company he once ran. Now he volunteers with the Pew Commission on Industrial Farm Animal Production. "One of my missions in life is to change the way animals are treated and how food is produced in this country," he says.
As part of the commission’s research, Niman visited one of the nation’s largest caged production houses in Colorado. Despite the state-of-the-art automated system, Niman was not impressed. "It’s pretty hard to put a rosy picture of 1 million chickens living five birds to a cage with no room to move around or stretch their wings," he says. "If I ran the place, I’d have trouble sleeping at night."
Niman believes the public wants to see reform in the food production industry. He says that this measure, and any laws that improve animal welfare, will only expedite what would eventually come naturally due to consumer demand. "I’m not one to advocate more and more legisutf8g, but I also know what’s going on out there," he says. "Change is so critical and coming that the sooner that change can begin, and the more orderly and methodical that change can be, the better off everyone will be."
Niman is part of a food movement centered around the Bay Area that includes author and University of California, Berkeley professor Michael Pollan, who also has expressed support for the measure. "The treatment [of hens] is important for reasons for morality, ethics, and sustainability," Pollan tells the Guardian, adding another ulterior motive for changing how hens are kept: "Eggs from hens that live outdoors on grass are a excellent product, even more nutritious and tasty." *
The news hit the front page of the San Francisco Chronicle Web site (www.sfgate.com) May 9 under a nice, subtle headline: "SF Weekly Loses Big, Again."
And while it’s not exactly a done deal, Judge Marla Miller appeared poised that day to finalize a $15.6 million award to the Guardian and issue an injunction barring SF Weekly from continuing to sell ads below cost.
The decision, expected this week, will bring the lawsuit to its next stage, as the Weekly and its 16-paper chain parent, Village Voice Media, threaten to try to overturn the 1913 California law that protects small businesses against big predatory competitors.
The Guardian‘s lawsuit charged the Weekly and Village Voice Media with vioutf8g the California Unfair Practices Act, which bars companies from selling a product below the cost of producing it with the intent to harm a competitor or reduce competition.
On March 5, a San Francisco jury found that the Weekly had engaged in predatory pricing and awarded the Guardian $6.39 million in damages. The law allows for treble damages.
Judge Miller opened the hearing by stating that, on the basis of legal briefs filed by the two sides, she was inclined to triple $4.6 million of the damages, leaving a final judgment of $15.6 million.
Although Guardian attorney Ralph Alldredge argued that the entire verdict should be tripled, the outcome wasn’t a big surprise: from the day of the verdict, we’ve been reporting that the likely final award would be around $15 million.
Forrest Hainline III, a new lawyer representing the Weekly, argued vociferously against any injunction, claming that the court would be wading into troubling First Amendment territory. He argued that the only way the Weekly could comply with an injunction would be to cut editorial expenses and that would have an impact on the paper’s right to free speech.
But Alldredge pointed out that courts have always found that newspapers have to pay taxes and obey basic business regulations. What, he asked, would happen if the Weekly were found guilty of dumping toxic printing-press waste into the bay? Would the paper argue that paying the cleanup costs would violate the First Amendment?
The argument wasn’t new the Weekly tried the same First Amendment claim early in the trial, when the paper filed to have the lawsuit dismissed. Judge Richard Kramer, who handled the first stages of the suit, rejected the argument. The Weekly sought an appeal of Kramer’s ruling, but the appeals court denied that as well.
Judge Miller seemed to imply in her questioning of Hainline that an injunction would only require the Weekly to do what it should be doing anyway: competing fairly. "Would you advise your client to go ahead and violate the law?" she asked.
Among the more interesting parts of Hainline’s argument was the claim that the Weekly would never be able to survive in San Francisco unless it could sell ads below cost. He essentially implied that the Weekly can’t make a profit on its own, and is in business only because its corporate parent is underwriting it.
Hainline said that he didn’t see how the Weekly would be able to sell ads at a price that covered its operating costs.
An injunction that would force the paper to operate like a normal business and live within its means would threaten the Weekly‘s very existence, Hainline argued, proclaiming that Miller was threatening to "silence a First Amendment voice." He implied that the Unfair Practices Act should never apply to newspapers and that the entire verdict ought to be invalidated.
Alldredge pointed out that it was silly to say the Weekly would be forced out of business. After all, he said, the Guardian is selling ads at a price that allows it to cover costs.
Miller took the matter under consideration and will issue a final ruling within 10 days.

1. City Hall has a bike room. For a while I thought only a scant number of city employees rode to work because the racks out front are usually pretty barren. Then I came across a storage room in the basement, near the café, full of bikes. What an encouraging sight. It was opened a few years back by the Department of the Environment, which is tasked with many of the city’s greening chores, and is available for all City Hall employees to park their rides safely inside.
2. More than 50 percent of San Francisco’s greenhouse-gas emissions come from transportation. Despite this, 20 percent of San Francisco residents polled in November 2007 by David Binder Research said riding a bike did nothing to curb global warming. Au contraire. Bicycles emit zero greenhouse gases (although the rider emits some carbon monoxide from huffing and puffing). A car produces roughly 20 pounds of CO2 for every gallon of gas burned. Gas stations in San Francisco sell about 953,000 gallons of fuel a day. At $4 a gallon, it would take about five months’ of fill-ups to buy every San Franciscan a $750 bicycle and that’s a nice bike.
3. Someday when you’re waiting for a BART train, take a good look at a system map. It has almost every East Bay bike trail detailed, and many of the trails connect BART stations with recreation areas. "There are a lot of great ways to get out to nature from BART," said BART board member Tom Radulovich.
4. BART is getting more bike-friendly. About 15 percent of the 580 trains now have removed seats to create special areas for bikes. (Look for the cars marked "Bicycle Priority Area.") Though some riders would like each train to have an entire car dedicated to bikes (Caltrain’s approach), a BART spokesperson told me that it would be difficult because cars are added and dropped throughout the day to handle fluctuating ridership. Soon more stations will be outfitted with bike lockers, for rent at a couple of pennies an hour with a BikeLink pass (for information, go to www.bikelink.org). Later this year, the Embarcadero Station will be getting an entire storage room (like City Hall’s, and again, partially funded by the Dept. of the Environment.)
5. One BART oddity: That groove running beside the stairs at the 16th and Mission station is to wheel your bike up and down rather than carrying it. Who knew? Not me. It’s a pilot project, so if you use it and like it, let BART know by calling (415) 989-2278 and the transit agency might install some more.
6. A San Francisco Bicycle Coalition (www.sfbike.org) membership provides mad discounts, and not just at bike shops. Get 10 percent off at Rainbow Grocery and 50 cents off beers at Hole in the Wall and that’s just the beginning.
7. Make sure you write down your bike’s serial number so it’s easier for the cops to track your ride if it gets ripped off (see "Chasing My Stolen Bicycle," 2/13/07, for more on bike theft in San Francisco). How do you find these magic digits? Flip your bike over and copy the number stamped on the bottom bracket where the pedals go through the frame.
8. Distant lands like Larkspur, Mill Valley, and Muir Woods are all much closer when you mix the bike with the boat. Marin has an amazing network of bike paths, and the Marin Bicycle Coalition (www.marinbike.org) has a map that one-ups San Francisco’s. (It shows the direction of the hills, not just the grade.) And … the ferries have bars.
9. DIY is the way forward. The three-class series at Box Dog Bikes (www.boxdogbikes.com), which covers flats, replacing cables, and truing wheels, is cheap and goes into enough depth that I no longer feel like there are certain parts of my bike I’m not supposed to touch with an Allen wrench. Follow it up with a membership to the Bike Kitchen (www.bikekitchen.org), a DIY shop with tools, parts, and people on hand to help you tune your spokes. It also regularly hosts "WTF" nights for girls, queers, and transpeople.
10. Need to know how to find the bike lanes and avoid the hills? Get one of those great bike maps (available at City Hall and at bike shops) when you join the SF Bike Coalition through a free download at www.sfbike.org/download/map.pdf. You can also pick them up at the energizer stations all over town on Bike to Work Day. It will help you find the best routes and navigate groovy spots like the Wiggle, which is the best route from mid-Market Street to Golden Gate Park. If you look along the sides of the streets, you’ll even see the green bike route signs that say "Wiggle." If you get lost, just look for a bike lane, which are well-marked all over town. Or follow all the other bikers.

The style and history of chaabi may be recognizable to few if any Westerners. But the examples performed on Abdel Hadi Halo and the El Gusto Orchestra of Algiers represent a unique and fascinating exchange between French, Spanish, and Algerian musical identity as well as the miscegenation of Jewish, Berber, and Arabic street culture in the heart of North Africa.
Translated from Arabic as “popular,” chaabi – originating in the Casbah as part of a Moorish/Andalusian tradition that stretched back to the 15th century – reached its height during the 1950s. Primarily performed in bars and clubs where many French expats, American GIs, Sephardic Jews, and Algerian Muslims congregated and swapped native instruments and scales, the cosmopolitan interplay of chaabi marked a complex colonial parity comparable to American Delta blues. With Algeria’s independence from France in 1962, over 100,000 pied-noirs (mostly Jews and European colonials) fled north from their homes fearing reprisal from the Muslim sanctioned government. And with them went much of the cross-cultural popularity of chaabi.
Although it lost much of its mystique among younger musicians, the forefathers of chaabi played on. Some, like El Hajj Muhammad El Anka, referred to as the “father of chaabi,” continued to teach and spread the genre’s musical heritage throughout Algeria until his death in 1978.
EDITORIAL On May 2, the day after thousands demonstrated for immigrant rights exactly one month after Mayor Gavin Newsom and Sup. Tom Ammiano stood in front of the cameras and announced a new initiative to promote the city’s sanctuary policy for undocumented residents federal agents swept into the city and arrested workers at El Balazo restaurant as part of an immigration enforcement raid.
It was bitterly ironic: much of the excitement of the large May Day rallies in San Francisco came from the diversity of the crowds and the connections among labor, antiwar activists, and immigrant-rights groups. The raid reflects the ongoing disaster that is US immigration policy under President George W. Bush arresting and deporting restaurant workers tears up families and communities, is a colossal waste of money, does nothing about the economic issues driving immigration, and damages the San Francisco and California economies. But it’s tough to get leading Democrats to take a strong stand on the issue: both Sens. Hillary Clinton and Barack Obama have ducked tough immigration questions during the presidential campaign.
And while San Francisco’s Rep. Nancy Pelosi, the Speaker of the House, was against the fence and called it a "terrible idea," she hasn’t said a word in public about last week’s immigration raid in her home city. Neither has Sen. Dianne Feinstein or Sen. Barbara Boxer.
There’s only so much San Francisco can do to block the Immigration and Customs Enforcement raids. The local sanctuary law bars city officials from in any way assisting ICE in apprehending undocumented immigrants, and Newsom and the Police Commission should direct Police Chief Heather Fong to investigate and ensure that there were no San Francisco law enforcement resources used, directly or indirectly, in the raid.
But local activists can do a lot to stop this insanity, using the sorts of political alliances we were encouraged to see forming at the May Day events. For starters, the antiwar, labor, and immigrant rights groups should call on Pelosi, Feinstein, and Boxer to denounce the raids and demand that ICE stop terrorizing California workers.
A couple Thursdays ago I went on the Johnnie Walker Journey – a traveling tasting show of Johnnie Walker’s five blended whiskies. Only now can I process this odd event.
First a quick note, I am often fairly cynical about these tasting events — whether they are put on by a liquor company, or whether they’re part of festivals that bring together a number of companies. I can think of a few at bars that have been joyous events (see: those held at Elixir), but often they take place in sterile rooms, and completely reduce the enjoyment of a liquor.
While The Johnnie Walker Journey, which took place at Fort Mason, fell into the latter category, it was so over the top it may have shot the moon. How do you turn the tasting of five liquors into something special? You build it into an overhyped multimedia event that is far bigger than it deserves to be.
The evening started off pretty lackluster. First we waited in line to “donate” five dollars to charity — which one they didn’t say. Then we waited in line to fill out a survey with one of the Johnny Walker Girls (much more wholesome than you’re picturing).
After a half hour, an announcer intoned that the time for the tasting was now. Again we waited in line, this time like we were entering Universal Studios. The email I had gotten about the event described it as a multimedia event. When I asked Travis Rexroad, the marketing guy who was helping organize this, what could be multimedia about a tasting event, he wasn’t much help with details.
After herding us together once again, we filed into the back room. Four groups of five rows of long white, soft benches faced the center, turning the normally dingy Fort Mason into something resembling a futuristic gathering of the elders.
Then came out the emcee. This guy, who looked like Richard Karn, had the job of stretching out the drinking of a total of 2 oz of liquor over an hour and a half. But his first job was to tell us where the exits were in case, in the middle of the show, we had to use the bathroom.
•The Last Mistress (Catherine Breillat, France/Italy, 2007) Catherine Breillat steps back from one of her bluntest provocations 2006’s Anatomy of Hell to deliver this barbed, intelligent adaptation of Jules-Amédée Barbey d’Aurevilly’s 1851 novel. Asia Argento is heroic as the titular courtesan, a seething, powerful woman working outside bourgeoisie bounds. On the eve of his marriage to a suitably chaste maiden, Mick Jaggerlipped Ryno de Maginy (Fu’ad Aït Aattou) narrates his decades-long affair with the magnetic mistress telling the tale to his fiancée’s grandmother, who is rapt. An intriguing cocktail of classical framing and modern malaise, The Last Mistress is Breillat’s best work in years not least of all because of her clear affection for the material. (Max Goldberg)

Alexandra (Alexander Sokurov, Russia, 2007) Alexandra‘s 70-something title figure (Galina Vishnevskaya) takes the laborious journey to Chechnya, where the grandson (Vasily Shevtsov) she hasn’t seen in seven years is stationed at a large army base. This latest by Russian master Sokurov isn’t exactly narrative-driven, but it’s one of his least abstract, most emotionally direct works. In her first film role, opera veteran Vishnevskaya doesn’t need to sing to etch a character whose long-suffering indomitableness is Mother Courage as Mother Russia. (Dennis Harvey)

•Black Belt (Shunichi Nagasaki, Japan, 2007) Hai karate! Ably armed with authentic martial arts aces in lead roles, auteur Nagasaki transforms his masterful piece of genre filmmaking into a parable, set on the eve of World War II, about the use of power and the wisdom of passive resistance. Black Belt trounces typical CG kung fu: that the actors are karate masters gives the film a texture of authenticity unseen since the days of Bruce Lee, Jet Li, and Jackie Chan, lending weight to thoughts and deeds. Brick Lane (Sarah Gavron, England, 2007) Adapted from Monica Ali’s 2003 novel, Brick Lane is a clichéd, romantic, finding-one’s-home story. Nazneen (Tannishtha Chatterjee) submits herself to the unexciting life of pre-arranged marriage until she meets Karim (Christopher Simpson), who sweeps her off her feet. One of the most aggravating things about the film is that Nazneen finds the power to take charge of her life through her affair alone. Apparently her daughter’s constant plea for Nazneen to start verbalizing her will was of secondary importance. (Maria Komodore)

•The Golem with Black Francis (Paul Wegener and Carl Boese, Germany, 1920) An original score composed and played live by the Pixies’ leader is a mighty enticement, but even without it this classic 1920 German silent would be worth seeing. Drawn from medieval Jewish folklore, it tells of a rabbi’s creation of a clay man to protect the ethnic ghetto from a Christian emperor’s heavy hand. Codirected by Wegener, one of the masters of cinematic German expressionism (who also plays the golem), it’s an impressive, strikingly designed mix of horror, history, and political commentary. •Just Like Home (Lone Scherfig, Denmark, 2007) Dogme95 filmmaker Scherfig hones her flair for bittersweet comedy with this goofily enjoyable ensemble piece about a misfit small town that falls into chaos. Much of the film’s story is seen through the eyes of a newcomer who has escaped from a bizarre religious cult; in accordance, Scherfig records the earnest bumbling of town folk through a unique lens, sometimes smeared with streaks of overexposed or double-exposed shapes and colors. The result is only as deep as a standard-issue Hollywood romantic comedy, but it’s deftly handled and slyly endearing. (Jeffrey M. Anderson)
•Lady Jane (Robert Guédiguian, France, 2007) Lean and mean as a killer B-movie, Lady Jane shows that the French noir still possesses a powerful measure of chilly fire. Its namesake, played by the 50-ish, formidable, and fierce Ariane Ascaride, perfectly embodies the genre. Roused from bourgeois slumber when her son is suddenly snatched, Lady Jane reconnects with two old partners in crime to raise a ransom. Director Guédiguian is overly fond of his flashbacks but redeems himself with the care he puts into imagery that avoids Bogart-by-way-of-Belmondo clichés. (Chun)
•You, the Living (Roy Andersson, Sweden/Germany/France/Denmark/Norway, 2007) There is one thing wrong with Swede Roy Andersson’s movies: there aren’t enough of them. His fourth feature in 30 years is another almost indescribable gizmo that strings together absurdist tableaux to increasingly hilarious and elaborate effect. From an incongruous Louisiana brass band to unhappy barflies forever facing last call, the characters here are comic Scandinavian-miserabilist pawns in a cosmic joke told largely through music and painted a fugly shade of lime green. Bizarre and delightful. (Harvey)
Fados (Carlos Saura, Portugal/Spain, 2007) Attempting to do for the Portuguese torch song what he once did for Spain’s gypsy blues with Flamenco (1995), Saura soars and stumbles with Fados, presenting wonderful performances and a few unfortunately dated modern-dance treatments. Chico Buarque, Mariza, Lila Downs, and Césaria Évora lend their varied styles and impassioned voices to the form. But one wishes Saura would have stepped aside further for the effervescent, soulful lilt of Caetano Veloso; the plush, liquid tones of Lura; the arch, curled-lip warble of Ana Sofia Varela; and old world narrative grace of Carlos do Carmo. Ice People (Anne Aghion, USA/France, 2007) The movies have long made the Antarctic the terrain of terrifying monsters and cute creatures, but the beings discovered by Anne Aghion in this documentary bare fatigue, not fangs, and they are far more prickly than cuddly. Aghion’s portrait of the inhabitants of the McMurdow Research Station spends most of its time with a satellite group of four geologists looking for 20-million-year-old leaf fossils. There’s more depth in the fantastic landscapes, which Aghion lenses far more flatteringly than she does her human subjects. (Sussman)
Mataharis (Icíar Bollaín, Spain, 2007) Charlie’s Angels this ain’t: these investigators and would-be Mata Haris of an all-female Madrid detective agency have the unwashed hair, sensible shoes, and bad marriages of everyday wage slaves. Actress-director Bollaín’s skillful, empathetic knack for capturing the grubby, low-light details of working women’s lives glimmers through the pale haze of this promising film. But she falters with the application of narrative-flattening sentiment, predictably reassuring story arcs, and the occasional cheesy slo-mo effect. (Chun)

Walt & El Grupo (Theodore Thomas, USA, 2007) In 1941, Walt Disney and a band of animators, writers, and other artists which came to be known as El Grupo journeyed to South America on a goodwill tour. This documentary, codirected by the son of one voyager, gathers wonderful photos, home movies, and a dazzling collection of drawings and cartoon clips to re-create the trip. The trouble is that there’s no real drama. The cumulative view is as sharply Eurocentric as Disney’s was when he went on to make cartoons such as 1942’s Saludos Amigos. (Anderson)

•Forbidden Lie$ (Anna Broinowksi, Australia, 2007) Norma Khouri made headlines and toured the talk show and lecture circuit as a crusading heroine when her 2003 international bestseller Forbidden Love highlighted the phenomenon of honor killings in pockets of the Muslim world. Trouble was, her heartrending story turned out to be a fabrication. As filmmaker Anna Broinowski grows increasingly exasperated with her subject’s fibbing and evasiveness, this documentary develops from an exposé into a portrait of a serial con artist one would be quite happy to see writing her next book from behind bars. •Picking Up the Pieces (various, 2007) The most intriguing piece in this shorts program about things lost and found is Death Valley Superstar, Michael Yaroshevsky’s half-hour documentary focusing on Marc Frechette, who was picked off the street to star in Michelangelo Antonioni’s 1970 Zabriskie Point. Taking his role as a student revolutionary into real life, he subsequently tried robbing a bank, was arrested, and died in prison under suspicious circumstances. Also excellent is Radu Jude’s 25-minute Romanian drama Alexandra and John Magary’s The Second Line, a narrative revolving around a FEMA worker in post-Katrina New Orleans. (Harvey)

A Stray Girlfriend (Ana Katz, Argentina, 2007) Writer-director-actress Katz maps out post-breakup transience with a wandering handheld camera and oblique dialog. As her titular character explores a rural township on Argentina’s coast, each scene teeters between bewilderment and menace. Lynne Ramsay covered similar terrain in her minor masterpiece Morvern Callar (2002), though with a dream-inducing soundtrack and enigmatic ellipticism far beyond Katz’s more vanilla approach. •Cachao: Uno Más (Dikayl Rimmasch, USA, 2008) Actor, would-be bongo player, and Cuban music fanatic Andy Garcia does right by his idol, the late Cuban musical great Israel "Cachao" Lopez, in this passionate tribute sprinkled with SF sights and centered around a Bimbo’s 365 Club concert. The show was apparently a hot one it also showcased Bay Area Latin music scholar John Santos, timbalero Orestes Vilato, and vocalist Lazaro Galarraga and director Rimmasch does it justice by using the performance as a narrative framework for a history that parallels that of contemporary Cuban music. Standard Operating Procedure (Errol Morris, USA, 2008) After profiling Robert McNamara in 2003’s The Fog of War, Morris jumps down the chain-of-command to summon US soldiers punished for the infamous photographs from Abu Ghraib. Ever the showman, he cuts from burnished interviews and photos to reenactments and slow-motion rumbles we "see" Saddam’s egg frying, giant prison ants, and an exploding helicopter. Such obsessive visualizations seem misplaced and morally confused. The Abu Ghraib story is, among other things, about the unstable, delicate nature of photographic representation. Yet Morris can’t resist auteur-stamped fireworks how else to explain the typically nutty (and utterly incongruous) Danny Elfman score? (Goldberg)

EDITORIAL It’s a bit odd (if not terribly surprising) that the San Francisco Chronicle ran a front-page story April 16 on public power and alternatives to Pacific Gas and Electric Co. and almost entirely ignored what’s going on in the paper’s hometown. And it’s striking (if, again, not surprising) that the story, by Kelly Zito, allowed a dubious expert from the University of California at Berkeley, who never supported public power and generally supports private sector and deregulation efforts to undermine, without rebuttal, the community-based anti-PG&E efforts.
But in the midst of this journalistic train wreck was the nut of a fascinating story: PG&E is on the ropes as communities try to find more renewable energy supplies and is fighting back in ways that are demonstrably illegal.
There’s a message here for San Francisco, where plans for community choice aggregation are moving along slowly but steadily. The giant private utility will be trying to sabotage the efforts here, and City Attorney Dennis Herrera needs to be moving now to make sure there’s no illegal interference.
The focus of Zito’s story was Marin County, where there’s an active and aggressive move to create a CCA (community choice aggregation) system that would replace PG&E as an energy supplier in 11 cities. The program would function as a buyers’ co-op, purchasing electricity in bulk for all of the businesses and residents in those communities, then using PG&E’s lines to transmit the power to customers. Marin is pushing the environmental angle: PG&E uses at most 12 percent renewable power, and Marin Clean Energy can offer consumers 100 percent green power. While that option might cost a bit more (an additional $5 per month for the average customer) Marin’s CCA also says it can offer a 50 percent renewable option that meets or beats PG&E’s rates.
The Chronicle‘s expert, UC Berkeley professor Severin Borenstein, is quoted as saying that it’s risky for cities to get into the electricity business. But that’s just horse pucky: cities have been in the power business for as long as there’s been electric power. In the Bay Area, Alameda, Palo Alto, and Santa Clara all have established successful public power agencies and all have cheaper rates than PG&E.
The state law authorizing CCA programs bars PG&E, a regulated utility, from lobbying against their implementation. In fact, in hearings before the state Pubic Utilities Commission, the company promised it would be neutral toward CCAs and wouldn’t try to discourage its customers from joining the public programs.
But in the Central Valley, where a group called the San Joaquin Valley Power Authority has been trying to create a broad-based CCA, PG&E has admitted it illegally tried to scotch the deal. Lawyers for the SJVPA filed a complaint with the CPUC, and on April 10, PG&E settled in a way that clearly admitted guilt. The company agreed to cease its illegal lobbying and pay the SVJPA $450,000 in legal fees.
It was a significant victory for public power and San Francisco needs to make it clear right now that it will fight just as vigorously to stop PG&E interference in its own CCA efforts. The CPUC is accepting comments on the settlement, and Herrera should file a statement supporting SVJPA, in effect putting PG&E on notice that it will face immediate, furious legal action if it dares try to undermine a San Francisco CCA. Herrera also needs to put a legal team together to prepare to fight PG&E as the city’s own plan moves forward.
It’s embarrassing that San Francisco the only city in the United States with a congressional mandate to run a public power system is behind Marin County and the Central Valley in getting its own CCA up and running. But the process is moving forward€. And the city needs to be starting its own marketing campaign to inform the public that cheaper, greener power is on the way.
Marin has been sending out fliers showing how effectively the CCA can replace fossil-fuel and nuclear generation with greener energy options. The county has clear information about lower prices and consistent efforts to fight global warming. San Francisco is lagging here and it’s time to get on the stick.
It’s Spring Break! No, not for students. They had theirs last month. This one’s for all of us: that blissful time between winter’s chill and early summer’s gloom when the sun shines its light (and sometimes even warmth) on our fair city. Which means bike rides without GoreTex, dresses without tights, torsos without shirts, and, best of all, picnics in the park.
In honor of this glorious season of backyard barbecues and patio parties, we’ve dedicated this FEAST to all kinds of sunny delights. We’ve got places to take a May Day date, bars where you can sip a tequila sunset while actually watching one, and a guide to the perfect places for carry-along cuisines.
But don’t forget we’re still the city of near-perpetual autumn. So we’ve added a couple places where you can turn up the culinary heat on those chilly nights when the fog’s rolling in not to mention quite a few places to wet your whistle in the style of that bastion of cold weather cuisine: Manhattan.
Time to get yourself some new shades, pull your sandals out of storage, and get your ass outside, before academic calendars and weather patterns have us all going "back to school" shopping and supping.
I’d burned out on vodka sodas. Straight tequila was making me nuts. And I couldn’t seem to find a decent margarita. I needed to find a drink with a punch, but one that didn’t lead to the dark under-eye circles the next morning. I didn’t think I’d love a cocktail again. That is, not until my friend handed me my first Manhattan.
Oh, the Manhattan. So simple and bold, with its combination of whiskey, vermouth, bitters, and a cherry. And so very American, with its East Coast name and Southern origins (the first versions in the 1870s were made with Kentucky bourbon, and most still are). I now have a patriotic devotion to this concoction, as well as an impressive ability to balance a martini glass in a crowded bar.
THE LIBERTIES
This Irish pub’s version of the Manhattan is strong and pure, tasting almost like straight Maker’s Mark. The only reason I knew there was vermouth included is because I caught a flash of green glass as the bartender mixed it. It was even served, unapologetically, without the drink’s trademark cherry (which, honestly, is fine by me). I guessed this particular formula was cultural the Irish don’t monkey with their whiskey but I was proved wrong when we tested our anthropological theory at the Phoenix, whose version is cloyingly sweet. If you really like your whiskey, stick with Liberties.
When you can’t get a sunny day seat at Revolution Cafe (hey, they only serve beer and wine anyway), head to Laszlo around the corner. Not only does it always have outdoor tables available, but it served one of the best cocktails on my tour: a smooth Maker’s Manhattan. It was stirred, not shaken which the bartender said keeps the drink from getting watered down and came with a brandied cherry. An extra bonus for daytime visits? You get to skip the North of Market nighttime crowd.
Need to show your out-of-town friends the Mission? Get them the neighborhood’s namesake drink at Blowfish, made with Ka No Ko Japanese whiskey. Served with a brandied cherry to balance the cocktail’s smoky taste, this Manhattan is certainly a crowd pleaser. Once you’ve liquored up your visitors in style, then you can take them to your favorite Mission Street dive.
The new swankfest on Valencia and 14th streets might break your bank and leave you hungry after dinner, but it’s a great place to treat yourself to sexy cocktails without fear of running into any of your financially-challenged friends. Conduit’s souped-up Manhattan, called the Heart of Islay, is made with Black Bottle 10-year-old Scotch, vermouth, Cointreau, and a splash of blood orange juice. The sweet ingredients help the cocktail go down smooth without overpowering the smoked wooden barrel flavor of the Scotch. Conduit’s classic Manhattan is great too, as it’s made with Old Overholt rye. Have one of each and you might even get the guts to taste the lamb tongue or pay a visit to the coed translucent glass restroom.

RANGE
The Third Rail is Range’s hybrid version of the classic pre-1940s Manhattan, made with Bulleit bourbon, Lillet Blanc (sweet wine), orange bitters, and lemon. This fusion blend is perfect for beginners, but it ain’t no classic. But a version made with Woodford Reserve, sweet vermouth, Angostura bitters, and a brandied cherry is as good as it gets. If you can find a seat at the bar, order two but stop there. A wise friend once said, "Manhattans are like breasts: two are perfect, but three are too many and just plain weird."
On the list of Nihon’s special happy hour cocktail, salad, and appetizer menu, where everything’s half price, is the Devil’s Manhattan. This cocktail is made with 100-proof Rittenhouse Kentucky Rye, SoCo, sweet vermouth, and bitters and for a mere six bucks, is definitely worth it. Sure, Nihon’s out of the way, but you probably need something from Rainbow anyway.
If you want to test your Jedi glass-balancing skills, order a Manhattan here on a weekend. The Manhattan here was by far the best dive bar version I tried made with Jim Beam, sweet vermouth, bitters, and a maraschino cherry, it was neither too sweet nor too strong.

Ten years ago, Epi Center was the first spa in the country to combine traditional spa treatments and medical procedures. Now it celebrates its anniversary with a new innovation: the ecomedspa. This LEED-certified arm of the original spa combines regular procedures with organic treatments in a healthy environment, all according to the principles of William McDonough’s "Cradle to Cradle."

Not only does this mean no trees are cut down, it also means employment for many women in Kathmandu Valley and financial support for village regions of Nepal. Plus, the paper’s gorgeous. Make a fashion statement with these simple, 100-percent organic T-shirts by Heidi Quante. The shirts, which are brown with white lettering saying "More Dirt" on the front are meant to capture attention and send people to Quante’s Web site, which shows people how to combat global warming through planting trees, establishing community gardens, and using permaculture techniques. Inks are made without PVC or phthalates, and shirts come in sizes for men, women, and babies.
Family owned and operated since 1984, A. Maciel specializes in recycled and tree-free papers as well as soy-based inks. What’s even better? The shop is completely wind-powered. Though the print shop is capable of doing corporate jobs, A. Maciel caters to nonprofits and community groups like the American Land Conservancy, Forest Ethics, and Greenpeace. They’re also part of Northern California Media Workers/Typographical Union. Sure beats Kinko’s.
All aboard the ecobus! This organization takes Das Frachtgut, the veggie oilfueled bus Jens-Peter Jungclaussen uses as a mobile classroom, on an ecofriendly party tour. Movie nights are all about watching modern classics and then doing some kind of relevant outdoor activity (e.g., see The Big Lebowski, then bowl outside). Dance nights turn the bus into a mobile DJ booth and an instant, impromptu club. It’s fun, safe (no drunk driving, kids!), and above all, Earth friendly.
