At the crossroads

San Francisco Ethics Commission executive director John St. Croix has admitted that his office knew in 2005 about the alleged laundering of public money into a San Francisco City College bond election campaign — well before the story broke in newspapers in April — but did nothing to investigate.

That startling revelation knits together two concurrent series that the Guardian has been running for the past two weeks: one on City College’s deceptive and unaccountable use of bond money and another on the uneasiness local watchdogs feel about the Ethics Commission’s ability and willingness to mete out balanced punishment to elections-law violators.

When news reports surfaced in April that City College allegedly had diverted up to $30,000 in public money to a bond election campaign committee, Chancellor Phil Day moved quickly to limit the fallout. So did independently elected trustee Rodel Rodis, who along with six other board members is responsible for controlling and managing the San Francisco Community College District.

During meetings organized that month to address the matter, Day came clean and blamed everything on a "relatively new" assistant vice chancellor. At least two trustees, one of whom had been recently elected, still wanted to know more about why it was allowed to happen. Rodis, on the other hand, complained that hiring an independent investigator at a cost of $75,000 to look into the matter was too expensive and framed the stories — written by San Francisco Chronicle investigate reporter Lance Williams — as an unfair attack on the college.

"Let’s be mindful that we’re still in a budget crisis and we still need to watch taxpayer money," Rodis said at one of the meetings.

Unlike Rodis, District Attorney Kamala Harris didn’t treat the allegations as insignificant and is now reportedly probing possible criminal violations in connection with the scandal. The investigation, Williams wrote recently, includes contributions made to the committee by contractors that did recent business with the school.

But where was the Ethics Commission during all of this? The controversy raises serious questions about why the agency never took any action against City College when, as its mission statement declares, its responsibility is to "actively enforce all ethics laws and rules, including campaign finance and open government laws."

Late in the commission’s July 9 meeting, St. Croix made the stunning admission that although his office knew about the allegations surrounding City College’s dubious handling of public funds all the way back in 2005, for some inexplicable reason it did nothing.

Staff shortages and poor financing have plagued the Ethics Commission since voters created it in 1993. Although the number of staffers has doubled during his three-year tenure, St. Croix nonetheless told the Guardian recently that his agency remains dependent on the public to help expose political candidates and campaign committees that break the law.

"We still rely on people and the city being watchdogs," St. Croix told us. "We’re supposed to be the eyes and ears for a lot of things, but we’re still extremely limited."

In this case, however, St. Croix’s office was well aware of allegations that City College bureaucrats had misappropriated public funds. The school’s Board of Trustees, along with Day’s office, created the Committee to Support Our City College in 2005 to convince voters to give the school $246.3 million in bond money to continue with a slate of capital works projects that began in 1997 and now are costing hundreds of millions of dollars more than anticipated.

The owner of a motorcycle training school claimed in a December 2005 letter to the Ethics Commission that he was told by the college to make a rent check for the regular use of school property payable to the committee instead of the school itself. Amazingly, the Ethics Commission pondered contacting the state’s Fair Political Practices Commission to disclose the allegations, which is the least it should have done, but never actually did so, as St. Croix has acknowledged only now.

"I take responsibility for that," St. Croix told us. "I don’t know who actually dropped the ball. But at the time we had less staff and there were a lot of things we were supposed to do and we weren’t doing."

Nor did the Ethics Commission contact the college to demand that it amend its campaign filings from that year to reflect the true source of that $10,000 payment and acknowledge itself rather than the motorcycle training school as a major contributor to the bond committee. St. Croix figured that could happen at the conclusion of the FPPC’s inquiry. Of course, the FPPC didn’t know about the allegations, at least not until the Ethics Commission finally contacted it in May, following the Chronicle‘s front-page stories.

The Ethics Commission’s lax approach to City College oversight also extends to trustees like Rodis, who has his own apparent campaign finance violations from his 2004 reelection campaign. That year, records show, his campaign failed to turn in three key election filings required to ensure that before heading to the ballot box, voters have a chance to see where candidates are getting their campaign money from. The commission sent his campaign several warning letters; just one of the filings finally arrived nine months later.

The trustee pointed to a campaign staffer when we contacted him regarding the tardy campaign statements. "We had someone working on the campaign who was supposed to do that," Rodis told us. "He indicated to us that everything was in order. We relied on him. We paid him. And then we found out later that he didn’t do what he was supposed to do…. It was one of those things that happen when you trust people."

The filing Rodis did manage to turn in shows that of the more than $44,000 he raised for his reelection effort that year, at least $1,700 had no identified donors, and other donations were marred by confusing data entry errors. An internal Ethics memo obtained by the Guardian that discusses the Rodis reelection campaign committee concludes that its poor reporting "appears to be a matter of willfulness and disregard for the law" and what belated filings do exist "present significant data problems." According to the memo, "Based on the record, significant questions remain regarding the true facts of the committee’s financing."

Rodis in 2004 won reelection to the board for the fourth time since he first became a trustee in 1991. According to our conservative estimates based only on the late filings, he could be liable for thousands of dollars in fines. *

EDITORS NOTES There was a fascinating moment July 11 at the San Francisco Board of Appeals meeting, a rare and revealing look into how city planning really works — and who calls the shots.

At issue was a proposal for two condo towers at Tenth Street and Market, one of which would soar 352 feet into the air — well above current height limits for the site. The developer also wants to put in 578 parking spaces, 399 more than the city Planning Code currently allows. It’s a monster of a project that would require seven planning code exceptions, two conditional use permits, and four zoning variances.

In other words, it’s not exactly what’s envisioned in the Planning Code for that particular lot.

But that didn’t bother Craig Nikitas, the city Planning Department staffer working on the project. In fact, in a long statement to the appeals board, Nikitas announced that city planners encourage developers to defy the current planning code since the planners think it’s outdated.

"The Planning Department encourages many project sponsors for tall buildings to use [a] height exemption," he said. That leads to "a taller building but a slimmer building…. That’s the kind of urban design we’re looking for nowadays."

Well, maybe — but the Downtown Plan, passed in 1984, calls for a very different type of design. It seeks buildings with setbacks (the so-called wedding cake look). That approach, which we all fought over in hearing after hearing before the Planning Commission and the Board of Supervisors, was designed in part to maximize sunlight at street level. That look may be old-fashioned architecture; it may not be what the current generation of planners wants. But it’s official city policy, city law.

If Nikitas and his boss, Dean Macris, want to change the guidelines for new buildings, there’s a procedure for that. You recommend changes to the Planning Commission, which can hold hearings and send new Planning Code changes to the Board of Supervisors. Then we all can discuss them in our usual, moderately civil, San Francisco fashion.

But that’s not how it works. Behind closed doors, the planners decide what they want the city to look like. Then they encourage developers to fit that model and bend the codes to make it all fit.

This is nothing new, but it’s rare to get such a clear admission, on tape, of why city planning in this town is so utterly screwed up.

In other news: there’s a bill before the State Legislature that’s supported by the San Francisco Chamber of Commerce and the Guardian. Labor likes it. The mayor likes it. The supervisors like it. And it could bring the city another $71 million a year in badly needed revenue (more than enough, for example, to solve Muni’s structural budget woes).

And yet it’s hung up in a Senate committee because Don Perata, the East Bay senator who is the president pro tem, doesn’t want any tax bills to go to the floor this year.

The bill by Assemblymember Mark Leno would allow — not require, but allow — the supervisors to put before the voters a proposal to increase the license fees on cars in this city to the level they were before Gov. Arnold Schwarzenegger cut them statewide. If San Francisco voters choose to tax their own cars, they will have the option; that’s all it is. Yet Perata’s press aide, Alicia Trost, told me it won’t even get a vote.

Gutting campaign reform

EDITORIAL A bill that could gut many local campaign finance laws is zipping through the legislature with the support of both the Republican and Democratic parties — and only a few activists seem to be paying attention. We’ve written about the bill, AB 1430 by Assemblymember Martin Garrick (R–San Diego), on the politics blog at www.sfbg.com. It has already cleared the State Assembly, 77–0, and is headed to the State Senate floor, where only one member — Carole Migden of San Francisco — has come out in opposition.

The Republicans and the Democrats love this bill because it would allow their parties to use unlimited amounts of money to support local candidates. That’s become increasingly common in this state; when cities set strict limits on contributions to political candidates, the candidates simply ask their big-money backers to give the money to the state Republican or Democratic Party — which then funnels the laundered, uncontrolled, and often unreported cash into local campaigns.

In fact, the bill comes from the San Diego GOP, which is angry that the San Diego Ethics Commission tried to crack down on nearly a million dollars in unregulated money that went to local races last year.

The bill talks about "membership communications" — as if the parties were simple nonprofits that wanted to send newsletters to their members. That’s not what’s going on at all, and everyone with any sense knows it. Here’s the real story: while the federal and state governments have refused to do any real campaign finance reform, cities and counties all over California have tried to fill the gap. The San Francisco Ethics Commission — for all of its obviously failings (see "Whose Ethics?," 7/11/07) — has the authority and the mandate to regulate local campaigns far more tightly than the state’s Fair Political Practices Commission. So the big donors, working through the state parties, are trying to figure out ways to circumvent local rules.

The conservatives in the State Legislature love to talk about local control when it comes to workplace regulations, environmental protection, and schools — but when a bill like this comes along and threatens to eviscerate local control, they utter not a peep. Nor, for the most part, do the liberals, who are aligned with the Democratic Party and don’t want to defy its mandates.

The San Francisco Ethics Commission has asked Mayor Gavin Newsom and the supervisors to oppose this bill, but the board has taken no action, and the mayor says he actually supports the bill. That’s a disgrace: at the very least, the supervisors should pass a resolution opposing AB 1430 and force the mayor to veto it.

Migden, after talking to the folks at California Common Cause, the public interest campaign organization, took a bold stand against the measure, and she deserves tremendous credit for that. Now the rest of the senate — starting with Leland Yee of San Francisco and President Pro Tem Don Perata of Oakland — needs to go along and kill this monster. *

Billboard sleaze

EDITORIAL Clear Channel is one of the biggest media companies in the world, with more than 1,100 radio stations, more than 40 TV stations, and a massive outdoor advertising network with billboards in more than 20 countries. This conglomerate, much despised for undermining independent broadcasting in this country, does business with a lot of government agencies, including the city and county of San Francisco. Clear Channel maintains the city’s bus shelters and runs the city’s pedestal-mounted newsrack program, and sells ads on the shelters and the backs of news racks.

So when Clear Channel does a favor for a local politician, it ought to raise eyebrows immediately.

That’s what’s happened with Sen. Carole Migden. Just as she’s fighting to defend local campaign reform laws (see "Gutting Campaign Reform," this page) Migden has been the recipient of tends of thousands of dollars’ worth of free billboard ads from Clear Channel. The ads were facilitated by local company executive Michael Colbruno, a former Migden aide who remains close to the senator.

We’ve been concerned about the billboards since they went up. At first, as we reported on www.sfbg.com, Colbruno refused to say who had paid for the boards, insisting they were independent issue-advocacy ads supporting Migden’s stances on the war in Iraq and rebuilding the state’s infrastructure. Migden came clean a few days later and told us that Clear Channel had, in fact, provided the ad space free; she added that her campaign had paid for the printing, although her campaign manager, Richie Ross, now denies that.

At the very least it’s awfully close to a legal issue: donors who sponsor issue-advocacy ads that promote individual candidates can’t coordinate those efforts with the candidate’s campaign. Otherwise the expenditure isn’t independent at all and ought to be reported as a campaign contribution.

Of course Clear Channel can’t contribute tens of thousands of dollars to Migden; the maximum contribution under state law is $3,600, and the company has already given her $2,500. "Therefore, presuming that the value of several billboards throughout San Francisco exceeds $1,000 dollars, Clear Channel has made a contribution to Carole Migden in excess of legal limits," states a July 16 memo from Reed and Davidson, a Los Angeles law firm hired by Migden’s primary opponent, Assemblymember Mark Leno. Migden may not be the only one involved in this Clear Channel scam; the company regularly sells or donates ads to local political candidates, and it’s entirely possible that others have gotten either discounts or partial gifts from the conglomerate.

For starters we’d prefer that Migden, and everyone else who’s running as a progressive in this town, eschew contributions from Clear Channel. But if such a powerful local operator is handing out favors, the details need to be made public, fully and immediately.

What was the actual value of what the company gave Migden? How closely was the deal coordinated with her campaign? What other local candidates have gotten free or cut-rate ads from this outfit?

The San Francisco Ethics Commission and the state’s Fair Political Practices Commission ought to investigate — and if it turns out that what Migden has done is legal, then the State Legislature needs to figure out a way to ban it. Meanwhile, the San Francisco supervisors, who are about to approve a new bus shelter contract, should demand that Clear Channel first release a full list of its billboard beneficiaries. *

Importing injustice

More than 100 tractor trailers were lined up at 6:30 a.m., inching toward the Port of Oakland’s Terminal 7, waiting for their next load. Against the backdrop of the San Francisco skyline, a mammoth freight ship emblazoned with the name Hyundai glided toward the port, pregnant with multicolor shipping containers.

A driver told the Guardian that he expected to be in line for at least two hours waiting to drop off the empty container attached to his big rig. His 1989 truck lacks air-conditioning, so the windows were rolled down, allowing diesel exhaust to pollute the air he was breathing.

It’s the same scene at many of the port’s other terminals: long lines of ancient trucks slowly snaking toward their destinations, their primarily immigrant drivers performing the essential and thankless task of transporting cheap clothes from Asia to the nation’s big-box retailers or helping to export California’s agricultural goods to Hawaii.

The fourth-busiest container port in the nation, the Port of Oakland is the economic engine of the region, providing thousands of jobs and more than $1 billion in revenue. But activists say that the port system has also led to sweatshoplike conditions for truckers and created a health crisis for the surrounding community.

On their poverty-level wages, truckers are usually able to buy only the oldest, most polluting trucks. Their diesel pollution is a major factor driving asthma rates through the roof in the neighboring, primarily African American neighborhood of West Oakland, where, the American Lung Association says, one in every five kids has asthma.

A new national coalition of labor, environmental, and community activists has advanced a proposal that would make all drivers employees with benefits, radically changing the way work is done on the waterfront and possibly heralding the return of the Teamsters to the ports for the first time in more than 20 years. In the process, the proposal would make the port’s biggest customers responsible for its environmental problems.

The coalition places the blame for the current situation squarely on giant retail shippers such as Wal-Mart and Target and is calling for them to be held accountable for the full environmental and labor costs of the cheap goods they sell — a call the corporations are strenuously resisting. The American Trucking Association, whose members contract directly with the corporation, has threatened a lawsuit if the change is adopted. But port officials have voiced a willingness to seriously consider implementing the proposal.

Having long claimed that the trucking industry is outside its control, the Port of Oakland could embrace the proposal as a means of satisfying community, environmental, political, and business concerns. With impending directives to clean the air coming from Sacramento, trade planned to almost double by 2020, two new Port Commission appointees representing labor and environmental concerns, and a federal antiterrorism tracking plan slated for this fall, the port is poised to play a leadership role that could reverberate up and down the West Coast and across the country.

THE TRUCKER’S LIFE


The Port of Oakland’s estimated 1,500 to 2,500 drivers are a far cry from the middle-class, long-haul Teamsters and the Smokey and the Bandit–<\d>style freewheeling rebels who have long been engrained in the American imagination. Instead, they are at the bottom of the port’s food chain and are the most exploited trucking sector in the country, consisting primarily of recent immigrants struggling to make ends meet.

Dawit Fre, 39, immigrated to Oakland from the small nation of Eritrea two years ago. "I wanted to see a better life," he told us. Fre was a driver in Africa and went to work for the Port of Oakland after his cousin told him people start their trucking careers there. He said he works up to 60 hours a week for one company, making the equivalent of about $8 an hour after expenses.

Fre arrives at work every day no later than 6:30 a.m., waits for dispatches from his company, and spends a minimum of two hours in line for each container he picks up or drops off. He is paid $42 for each load by the company. He doesn’t know how much the trucking companies make but has heard that some get $200 per load. He returns home around 6:30 at night.

"The whole time I’m at the port, I’m thinking about my family," he said. "I got children. The only thing I’m thinking inside the terminal is, how many moves am I going to do? Am I going to do four or five or three or two?"

On a good day he can get four, on a bad day as few as one, depending on the length of the lines and the generosity of the dispatcher. Then there are his expenses. As an independent operator, Fre is solely responsible for a tankful of diesel that costs him up to $250 a pop. DMV registration is $178 a month, and 12 percent of his weekly earnings goes to his boss for insurance on his truck, not to mention annual federal income tax.

He receives no benefits, no overtime pay, and no health care coverage at a time when his wife, a diabetic, is suffering from severe stomach complications. "I’m taking her to Highland Hospital," he told us. "If it’s easy for them to fix, they can do it. But if she has a big problem, they can’t do it."

Fre has his own health problems. "Most of the drivers, we have old trucks," he said. "You don’t have AC, your windows are down, and you get sick in the truck" from the diesel. Fre’s remedy for his persistent coughing and the burning in his throat is several glasses of milk after each day of work.

A 1998 study published in the Journal of Independent Medicine found that truck drivers face a risk of cancer 10 times greater than Occupational Safety and Health Administration–acceptable levels, and a 1990 study published in the American Journal of Public Health showed that truckers face nearly double the average lifetime lung cancer risk.

Fre has little money to invest in his truck, a ragged 1987 model that he said needs $5,000 in repairs. He doesn’t trust it on the freeway, so he’s asked his dispatcher to send him only from pier to pier, not outside the port, further dipping into his earnings. "I came here to see a better life," he said. "When I got here, I found it is different. Here we don’t get paid for the overtime. We don’t get benefits. When I get into the terminal, there is no respect."

His experience is typical of those of port truckers across the country. A study by the East Bay Alliance for a Sustainable Economy, a labor-affiliated think tank, found that the average Port of Oakland trucker makes as little as $8 an hour after expenses, works 11 hours a day, and spends two and a half hours in line per load. Almost none of the truckers reported receiving benefits on the job, and 66 percent don’t have health insurance.

This is consistent with data from a 2004 survey of port truckers in Los Angeles and Long Beach, conducted by a professor of economics at California State University Long Beach. That report found they had a median income of $25,000 a year after expenses and an average workday of 11.2 hours, with up to 33 percent of their time spent waiting in line.

Port truckers generally drive only the oldest, most polluting trucks because that’s all they can afford. An industry adage is that ports are "the place trucks go to die," a reality that has dire impacts on the surrounding communities.

POLLUTING THE COMMUNITY


West Oakland has long been a dumping ground for the Bay Area’s toxic waste. The community has one of the five highest asthma hospitalization rates in California, with an estimated 20 percent of its K–<\d>12 students suffering from the disorder, according to the ALA. Researchers at the University of Southern California have found that children living within a few hundred meters of freeways leading out of ports not only are more likely to suffer from asthma but also actually develop smaller lungs.

Margaret Gordon, a 60-year-old community health activist who has lived just blocks from the Port of Oakland for 15 years, told us that she and four of her grandchildren living with her all suffer from asthma. When one grandchild was born with severe asthma and her own asthma worsened after she moved to West Oakland, Gordon, then a housekeeper, started reading about the causes of asthma and made the connection to the port. Like many in the low-income neighborhood, she cannot afford to move elsewhere in the Bay Area.

Gordon has been fighting for clean air for more than a decade, and in April she was inducted into the Alameda County Women’s Hall of Fame for her work. In 2001, Gordon formed the West Oakland Environmental Indicators Project, which she now cochairs. The project has released more than half a dozen studies related to air quality. A 2003 report showed that trucks traveling through West Oakland in one day produce the same amount of toxic soot as 127,677 cars, leading to indoor air in some neighborhood homes that is five times more toxic than that in other parts of the city.

Still, Gordon told us that port officials are "only starting paying attention." Last year the California Air Resources Board passed a resolution related to air quality at ports and announced that it was developing a regulatory mechanism. A 2006 CARB report found that truck diesel exhaust accounts for the majority of the estimated 2,400 deaths related to freight transport each year and 70 percent of the state’s air pollution–<\d>related cancer risk. Freight transport will cost California residents $200 billion in health costs over the next 15 years. Most of this is borne by low-income communities of color near freight transport hubs.

The combination of state mandates and local community concerns is starting to spark a change. "They would sit down and talk with us before that, but there was not anything concrete done," Gordon told us. The port is now in the early planning stages of an air-quality-improvement program, working with Gordon and other activists.

That movement is getting vigorous new support from the Coalition for Clean and Safe Ports, a national partnership of labor, environmental, and community activists organizing at the country’s major container ports: Los Angeles, Long Beach, Miami, Oakland, New York–New Jersey, and Seattle.

"Every one of those ports has the same environmental and labor problems we have in Oakland," Doug Bloch, the coordinator for the coalition in Oakland, told us during a tour of the port’s heavy industrial landscape. Virtually all of its 900 maritime acres are covered by concrete and asphalt, monster cranes that inspired Star Wars‘ Imperial Walkers, and 20-foot steel containers stacked up like Legos behind chain-link fences.

The Port of Oakland has no direct relationship with its truckers at the present. Shippers take price bids from among roughly 100 trucking companies at the port, then contract the work to the independent-contractor truckers. The CCSP says bidding wars lead to poverty wages for truckers, older trucks and more pollution, and a chaotic port full of inefficiencies like long pickup waits.

Under the proposed system, ports would call on their ability as landlords to set standards for the trucking and shipping companies. They would require trucking companies to hire drivers as employees, shifting maintenance costs from the drivers to the companies, which would retrofit or replace all port trucks with more environmentally friendly rigs. The ports would allow only new, cleaner trucks to enter. The companies could then, in theory, pass the costs on to shippers and end users.

If drivers were paid as employees by the hour instead of by the trip, the coalition expects the market would reduce inefficient truck wait times and air pollution.

"When you rent an apartment you sign a lease," Bloch told us. "If you trash the place, you get evicted. Corporations are trashing this community, but they’re not being evicted."

A test case could soon be under way at the ports of Los Angeles and Long Beach, the two largest in the United States, and the situation is being closely watched by ports and industries across the country. Port commissioners there had hoped by the end of this month to approve the coalition’s program, which they expect to reduce diesel truck emissions by as much as 80 percent over the next five years. But growing opposition and the threat of lawsuits by groups like the California Trucking Association, which represents the owners of truck companies, and the Waterfront Coalition, a consortium of major retailers, led the ports to delay their decision. The commissioners now expect to vote in September after completing an economic impact survey.

At the center of the storm is the fact that as employees, truckers would be able to organize and form a union. As independent contractors, they are barred from doing so because of antitrust laws originally created to oppose vast enterprises that dominated industries. (A further irony is that giant retail steamship companies have experienced incredible consolidation and enjoy a limited antitrust immunity.)

If passed by LA port officials, the plan would be implemented there starting Jan. 1, 2008, and could result in a domino effect at the other, smaller ports across the country. "The industry is fighting like hell in LA," Bloch told us. "They know that if they’re going to have to pay, the party’s over."

Meanwhile, Bloch told us that more than 1,000 truckers have signed a petition asking the Port of Oakland to pass a version of the coalition’s proposal, and it will be presented to the Port Commission, the seven-member body that would eventually vote on the proposal. Spokesperson Libby Schaff told us that the port "agrees with the coalition that the port can and should have a more direct relationship with its truckers" and is "very seriously considering the coalition’s proposal."

Because the proposal "constitutes a major overhaul of the way trucking is done today," Schaff said the port is currently holding stakeholder meetings with residents, truckers, terminal operators, elected officials, the business community, and labor to consider it in the context of a more comprehensive port plan. Schaff said a comprehensive plan could be crafted in less than a year.

The port has not taken a position on granting truckers employee status. It is also looking into other funding mechanisms for a clean-truck program, including money from a pending state bill that would impose a $30 fee on every 20-foot-equivalent unit passing through the Los Angeles, Long Beach, and Oakland port complexes, to be used for improvements in road and rail infrastructure and for clean-air programs.

The legislation, Senate Bill 974, by Alan Lowenthal (D–Long Beach), would generate more than $525 million annually. But it faces tough opposition from some very powerful interests.

RESISTING CHANGE


Bill Aboudi, president of Oakland’s AB Trucking and a member of the CTA, told us truckers are "treated like second-class citizens," and he believes long lines and trucker asthma are serious problems. But he strongly opposes the coalition’s proposal. Instead, he told us, state regulations like those forthcoming from CARB and other piecemeal reforms are the answer.

"The coalition’s main goal is to unionize the drivers," Aboudi said. He was wearing a baseball cap emblazoned with two American flags and the words "Oakland Trucker." An immigrant from Israel, he has been at the Port of Oakland since 1992. "If these guys choose to be owner-operators, why are you rocking the boat? You can’t be playing with my livelihood just because you want to get union dues," Aboudi said. "Truckers want to own a piece of the American dream. They want to own their own truck."

It’s an appealing image to many. Kevin Leonard, an owner-operator trucker who contracts with Aboudi and others, told us he doesn’t want to give up his independent status. "I have the freedom to work when I want," he said. "I don’t see how the Teamsters can represent me better than I can."

The trucking industry as a whole says the coalition plan will force away trade and drive out small trucking companies, which will have to maintain the trucks and start paying benefits such as health insurance and workers’ compensation.

Yet Assemblymember Sandré Swanson (D–Oakland) brushed aside those arguments. "I’ve been involved in Bay Area politics for more than 30 years," he told us. "I’ve seen these same claims made against farmworkers as they were organizing for better conditions. I’ve seen these arguments made when we were raising the minimum wage. I think the opposite is true. If you have a workforce with a livable wage, it’s a more productive workforce, and I think everyone benefits. Truckers deserve more, and we’re going to do what we can to help them."

Oakland City Council president Ignacio de la Fuente, who drafted and helped pass a minimum-wage law for port employees, told us he supports the right of truckers to unionize but labor and environmental concerns must be balanced with economic growth. "You can’t ignore the fact that you have the port of Oakland competing with other ports," he said. "I support the fact that the Teamsters are going to bargain collectively on a national level. This port competes with other ports, and you cannot be put at a disadvantage."

Bloch says the coalition’s target is the shipping companies, not the trucking companies. "The shippers are hiding behind the trucking companies," he told us. "On the one side there are the giant shipping companies, like Wal-Mart and Target, huge global companies that demand low prices from trucking companies. On the other side are tiny trucking companies, immigrant truckers, and communities of color. Wal-Mart’s slogan is ‘always low prices,’ but ‘always low prices’ means one out of five children in West Oakland with asthma and drivers making $8 an hour who can’t support their families."

Oakland mayor Ron Dellums may be signaling his support for reform with two new appointees to the Port Commission. Even before he took office, Dellums was working to influence the Port Commission; as mayor-elect, he requested that outgoing mayor Jerry Brown hold off on appointing a new nominee so Dellums could appoint someone working on environmental and community impacts. He lost this battle when a majority of the city council voted to appoint Mark McClure, the director of marketing at a business technology company focused on security.

Dellums’s latest appointees, announced earlier this month, are a marked contrast to the business-oriented appointees of the Brown era: Victor Uno, a financial secretary with the International Brotherhood of Electrical Workers, and Gordon, the longtime resident and environmental activist in West Oakland.

"The port’s policy has been all about business and not about the people," Gordon told us. "The mayor really wants someone there to talk about health issues. I have never known a mayor to put someone on the commission and one of their engagements is to talk about health." She would also like to see a public participatory-process policy built into the port. "This is about sharing the power," Gordon said. "I don’t think West Oakland residents know they have power." She has "no problem" with truckers unionizing but also wants to find a way for drivers to remain independent contractors if they prefer.

Uno told the Guardian that he is highly supportive of the proposal. "I think that if the whole commission takes the lead of Mayor Dellums that this proposal will be very seriously considered," he said. "I’m very optimistic." Asked if he thought a proposal could succeed without requiring trucking companies to hire truckers as employees, he said, "I do not see how that is possible, given the lack of regulations in the trucking industry. It’s a dog-eat-dog world among independent truckers."

DEREGULATION HISTORY


The ports were not always structured as they are now. Before the 1980s the Interstate Commerce Commission regulated trucking, and most truckers at California ports were members of the Teamsters. They had health care, pensions, and workers’ compensation insurance and were paid a middle-class wage.

As part of a national push toward deregulation in the late 1970s, Congress, spurred by President Jimmy Carter, deregulated the trucking industry in 1980. In the following few years, a flood of new trucking companies entered the ports, with shippers choosing between a growing number of companies for each job. As small trucking companies undercut one another in bidding wars, the falling rates translated into declining driver pay, the bankruptcy of Teamster-organized companies, and increasing reliance on independent contractors whom companies could hire without spending money on payroll taxes, health care costs, or other benefits that unions might try to extract.

Trucking expert Michael Belzer, an economics professor at Wayne State University, has shown that long-haul truckers now earn less than half of prederegulation wages and work an average of more than 60 hours a week, while retailers like Wal-Mart have thrived. "The low rates paid to truckers in this global-trade game acts as a subsidy for increasing the amount of trade," Belzer told us. "Pollution and safety hazards are the negative externalities." If all ports on the West Coast required employee drivers, he said, "the market result would be that cost and safety would go up, and pollution would go down."

There have been a handful of Teamsters-related or trucker-led rallies and work stoppages at the Port of Oakland since deregulation, including a technically illegal strike in 2004 protesting the soaring price of diesel fuel, which virtually shut down the port for eight days. Many of the same complaints of today’s port truckers were aired at that time — long waits in lines, poor pay, long hours, and no benefits.

"This business is like the Mafia," Lorenzo Fernandez, 36, said, standing in front of two metal taco trucks glinting in the noon sun, along with about a half dozen other truckers on their lunch break. "They’re doing whatever they want with us, between the [truck companies] and the shippers. There is so much competition between the companies, and they know that we need the job. They know that our kids will go hungry."

Muhammad Khan, 33, said he’s sometimes forced to make up for long wait times by driving dangerously fast on the freeways. "We have our families. We have to take care of them. We all risk our lives because we have to. We don’t make enough money if we don’t make a load," Khan told us.

"We’re all immigrants here," Fernandez said. "We make it possible for the economy to grow up, but they’re stepping on our faces…. We have to work together. Otherwise we are going to be slaves for life."

A sign on a chain-link fence near the taco trucks reads, "Got an old truck? The Port of Oakland can help! Replace your old truck today!" Call the number at the bottom of the sign, and a recorded message issues an invitation to an informational barbecue that took place four months ago. The message explains that the port will provide qualifying owners with up to $40,000 to replace trucks dating from 1993 or before with a 1999-model truck. But Schaff told us, "Due to overwhelming demand, new applicants are currently not being accepted."

Money for the program came from a $9 million settlement of a lawsuit West Oakland residents filed against the Port of Oakland in 1998, alleging that their health was being harmed by port operations. The port says it will replace a total of 80 of the estimated 2,500 port trucks with those funds. When asked if the port had a responsibility to truckers, Schaff said it was "consistent with the port’s commitment to social responsibility…. We’ve done a lot, and we’re going to do more."

But the only specific programs the port could point to were the truck replacement program, a trucker access committee and working group started after the 2004 strike, and new GPS cell phone technology that is being touted as a solution for bottlenecks. Chuck Mack, the Teamsters’ Western Region vice president, isn’t impressed. "They’re a joke," he said of the programs. "Very few independent contractors have utilized them."

The recent purchase of the GPS system particularly irritates Mack. "Here is a quasi-governmental agency supplying services to the trucking companies," he told us. "It’s bizarre that we’re using taxpayer money for this. Any other industry would buy the devices themselves."

"We don’t disagree with using this money" for truck replacement, Mack said, "but what you’re doing is blowing $2 million in taxpayer money. Years down the road they’re going to need a new truck and another million in taxpayer money. For Wal-Mart and Target it’s great because they can have the taxpayer pick up the bill. Without changing the model, it’s just a short-term fix at the expense of the taxpayer."

EMPLOYEE BENEFITS


Beyond the environmental and economic benefits of making truckers employees of the companies, the change also might improve port security. The federal Transportation Worker Identification Credential program, expected to be implemented in the fall, will check the identities of the nation’s 750,000 port employees, 110,000 of whom work as truckers. Under the present system, there is no way to track the independent port truckers.

Employees are easier to track, and they are also better for port security in other ways. Among low-paid port truckers, turnover rate is extremely high, according to the ATA. "We all know that having a stable, well-trained, reliable workforce only leads to more security," Bloch said. "If they’re trained, they can be the eyes and ears of the port."

Well-paid truckers also would lead to safer ports. In a 2005 report, Belzer showed that "a substantial fraction" of independent operators actually loses money each year, resulting in "a high risk of unsafe operations among those earning the least money." The low compensation also "presents a national security risk," his report read, "since those who desperately work to break even might be at risk to engage in activities that put the nation at risk, whether intentionally or unintentionally, just trying to find a way from not going under."

Driving past another long line of trucks idling outside a gate after lunch break, Bloch pointed out one truck. A placard on the back of the rig read, "End sweatshops on wheels."

The current port system "just heaps abuse and abuse on these truck drivers and this community," Bloch told us. "The big businesses like Wal-Mart don’t pay the cost of polluting Oakland. It’s the truck drivers and the community that pay the cost. People pay with their lives."

"You can’t fix the environmental problems without fixing the problems of the driver," he said. "And now you have labor and the community coming together, and that’s powerful."*

Frenemies with benefits

I recently broke up with my girlfriend (I’m a woman). Everything had started out peachy and remained so until about a month and a half before the breakup. It seemed that our growing emotional intimacy triggered her childhood issues (neglect, abuse, you name it … followed by addiction; she’s now thankfully in recovery), and she started pushing me away, then moved on to heavy criticism and blaming. As an abuse survivor myself, I know the signs and can empathize, but I feel that I’ve worked through most of my issues with intimacy, whereas she is, in her own words, "scared of loving." Anyway, our sex life suffered greatly. I felt that I was giving a lot and not receiving much. I tried talking with her about all this, but she insisted that I was the one at fault for everything. Finally, drained and heartbroken, I left her. Since then, she’s apologized and told me that she’s working on changing her patterns (through therapy, support groups, etc.). And she wants a second chance.

I feel relieved to be out of a tense and draining relationship, but I also miss the good stuff we had (hot sex — most of the time — and friendship, if not emotional intimacy). I know I can get over this and find love (though right now sex is first on my agenda) with someone else. That said, could her willingness to heal (and treat me with respect) make it worth taking another stab at it? Also, if the sex and friendship worked for us but not the relationship, what are the odds that we could be lovers but not partners (we’re both nonmonogamous)?

Oh, eek, I’m a little scared of your ex, to tell you the truth. I’ll probably get in trouble for this but she immediately put me in mind of stories a friend of mine tells of working at an extremely PC community nonprofit and the way interns and other untested newbies would respond to a request that they do some — oh, I dunno, I think they call it work? — with a trembling lip and a defiant stance and a declaration that "I find that really triggering." "Oh, I’ll trigger you, all right," my friend would think, but of course you can’t say that sort of thing to that sort of person, you can only try to gently redirect them, like toddlers or puppies, if you don’t want to be accused of being abusive and hierarchical and tool of the patriarchical and end up having to endure lengthy sessions with a mediator wearing chunky ethnic jewelry and many complicated but unstructured garments woven from colorful twigs and berries.

I can’t really answer your last two questions, of course, because even if I had actual statistics to give you ("Blah percent of couples attempting friendship with benefits following a breakup ends up throwing kitchen implements at each other within six weeks, while only bleh percent of couples attempting friendship without benefits throws plates …") they would still just be statistics: interesting to read, but more descriptive than predictive.

Just going by the fairly small amount of info I’ve got, I have to admit I’m doing a little preemptive cringing and ducking myself. Things just sound a little too fresh and volatile to go trying any tricks as death-defying as getting back together but not really, which is a pretty dangerous stunt no matter where in a relationship’s history one attempts it. So while I won’t lay odds or place bets, I’m happy to make a wild prediction based on nothing more than having a good head for these things: attempting to reassemble your former relationship minus what are arguably the most important elements (emotional intimacy, not to mention luv) is doomed to failure. Before you know it you will be "triggering" her again, this time quite possibly on purpose (I was tempted to add "and with a real trigger this time," but it wouldn’t be tasteful). I think you’d do best to look elsewhere for sex and attempt friendship, cautiously if at all, with your ex. If you’re meant to be together (by which I don’t mean "fated," but merely "suited," in case you were wondering) you will find yourselves shifting back in that direction when you’re ready. It’s nice and all that she’s "willing to heal," not to mention treat you with respect, but frankly, all you have is her word on that. She hasn’t actually done either one so far, has she? And also frankly, you sound neither so hard up nor so desperately pining for her as so make it worth the probable unpleasantness. Exes are in some way the easy choice — you don’t have to go out and meet anyone, which for some of us anyway can be a powerful draw, but on the other hand you don’t get anything better than what you already had and gave away, and usually with good reason.

I just wouldn’t.

“Transformers” without irony

TECHSPLOITATION There is absolutely nothing wrong with enjoying truck commercials. Enjoying truck commercials can even be a politically innocent act — it does not signify that you secretly lust after fossil fuels. Plus, there’s a payoff to admitting that such pleasures can be had guilt free: you can enjoy watching Michael Bay’s latest sci-fi actionfest, Transformers, on its own terms. If you’re one of the people who helped the flick earn more than $100 million during its opening week, you may not need my help. For those still fighting the urge to cheer for shiny trucks, I offer a few arguments to persuade you.

The first, most obvious case in favor of this movie is that it just looks neat. There are giant robots that turn into, among other things, SUVs, tanks, fighter planes, scorpion things, race cars, and yes, trucks with flames painted on the sides. It shouldn’t be too surprising that computer-generated imagery is the perfect tool for demonstrating how cars morph into robots. Haven’t you always wished that one day your boring old Prius would twist itself into a gigantic alien robot from the planet Cybertron?

Ah, Cybertron. This brings me to my next argument, which is that Transformers is one of those rare action movies about incredibly silly things that take those silly things dead seriously. No doubt you are as heartily sick of knee-jerk irony as the next chump who shelled out cash to see Ghostrider (OK, so I liked Ghostrider, but you know what I mean). There are no great actors in Transformers showing us how distanced they are from the trashy source material by "acting" à la Nicolas Cage. In Transformers, characters discussing the robots refer to them, with straight faces, as Optimus Prime and Megatron. The good guys are Autobots and the bad guys are Deceptacons. They are all trying to find a giant, unexplained box called the All Spark. Nobody raises an eyebrow at the total goofiness of this scenario. The film’s straightforwardness is downright refreshing.

Like other kid-friendly action films, Transformers is low on bloodshed and high on "Wow, that’s cool!" Even the film’s worst bad guy, a government secret agent played with snarky relish by John Turturro, never kills anybody. Instead of murderous mayhem, the movie offers us rampaging teenage hormones, packing the dialogue with cute but groanworthy double entendres about asses and dicks and humping. Not since E.T. has a movie aimed at tweens been this honest about how kids really talk: there’s a lot of creative cursing, and main character Sam (Shia LaBeouf) spends the entire flick trying to snog his hot pal Mikaela (Megan Fox). Thank you, Michael Bay, for removing rampant death from the action-movie genre and replacing it with dumb masturbation jokes.

What truly surprised me about the movie was that Bay did a fairly good job updating the concept for the 2000s. The film’s plot hinges on something Sam is selling on eBay, and there are a few good jokes about how the Autobots learned English on the Web (surprisingly, this does not mean that they yell "LOL" or "OMG" all the time). I was deeply amused when the evil Deceptacons hunt Sam down via his eBay listing, ambush him, then grab him in their giant metal fists so they can scream in his face, "Are you user LadiesMan217?"

Another way Bay updates the Transformers premise is by connecting the Deceptacons with the Middle East. The film has this sort of murky, inexplicable opening sequence that takes place in what we’re told is "Qatar, Middle East," where good US soldiers encounter mean, scorpion-shaped Deceptacons who smash the crap out of them. The Middle Eastern ‘bots look bizarrely like improvised explosive devices come to life; made of scrap metal and old tires, they hide in the sand and strike at unwary troops who are trying to be nice to the native folks. This is possibly the only part of Transformers in which Bay attempts to grasp feebly at political relevance and make something other than a zoomy truck commercial. Of course, he fails miserably. If you want to enjoy this flick without guilt, you will have to ignore the whole Middle East issue. Of course, one could say the same thing about living in the United States. Maybe Bay has succeeded in pulling off some social commentary after all: welcome to the United States — ignore the Middle East stuff, but stay for the masturbation jokes and cool special effects. *

Tweeking the tidelands

With the furor over her erratic driving incident still lingering and a primary challenge from Assemblymember Mark Leno starting to get nasty, state senator Carole Migden is now wading into another potentially pungent political pool.

This time around, the battle involves the state’s laws governing coastal land use, the Port of San Francisco’s revenue needs, and the competing interests of folks who live along, work near, or simply like to relax and recreate along the city’s bayside waterfront.

Migden’s Senate Bill 815 would make three major changes to the ancient and arcane laws that govern the use of the state’s tidelands. It would allow the port to rent out 11 seawall-protected properties, currently used for surface parking lots, for development over 75 years, after which they would return to the public trust.

It would also permit the port to sell off "paper streets" — lots that serve as view corridors, public rights-of-way, and connections between the city and its waterfront, including portions of Texas, Custer, Ingalls, and Davidson streets developed with warehouses, as well as the recently closed Hunters Point Power Plant.

Last, Migden’s bill would allow the transfer of the 36-acre, federally owned Jobs Corps parcel on Treasure Island to local control as part of an exchange of public trust and nontrust lands on Treasure and Yerba Buena islands.

Port special project manager Brad Benson told the Guardian that the local agency worked with the California State Lands Commission for two years on ways to help increase the port’s revenue-generating capabilities, and this bill was the result.

"We cc’d the neighborhood organizations on the amendments that we sent to Migden’s office on June 12, and we invited further discussion," Benson said of the proposal, which is intended to help cover the port’s estimated $1.4 billion cost for seismic retrofits and restorations, hazardous-material remediation, storm-water management, and improved waterfront access by relaxing the land-use restriction of the 1969 Burton Act.

The Burton Act gave the port control of San Francisco’s waterfront from Fisherman’s Wharf to Candlestick Point, including 39 historic finger piers between Fisherman’s Wharf and China Basin. But it also limited the port to leasing seawall lots for street purposes such as surface parking while giving it the financial responsibility of maintaining and restoring the historical waterfront.

Today just about everybody agrees that surface parking is a horrible use of the seawall lots — with the possible exception of the Giants, who want to retain 2,000 spaces on the 14-acre lot they lease next to Mission Creek. But in recent weeks disagreement has broken out over last-minute amendments that were added to Migden’s bill June 20 to impose height limits on four seawall lots in the Northeastern Waterfront Historic District and remove a fifth lot entirely.

Those amendments were added following input from neighborhood groups like the Telegraph Hill Dwellers, the Barbary Coast Neighborhood Association, and the Friends of the Golden Gate, a 1,400-member nonprofit whose stated goal is "to preserve open recreational space for the citizens of San Francisco."

In a June 20 letter to Migden, Telegraph Hill Dwellers president Vedica Puri argued for height limits on the basis of a "visual and historic connection between the waterfront and Telegraph Hill" created by "higher structures closer to the base of Telegraph Hill and lower buildings near the Embarcadero." Noting that three of the disputed lots are currently zoned for heights of 40 feet, with the fourth lot, closer to Telegraph Hill, zoned for 65 feet, Puri argued for respecting local height limits in place as of January.

Meanwhile, the Barbary Coast Neighborhood Association, the Telegraph Hill Dwellers, and the Friends of the Golden Gate asked that lot 351, which abuts the Golden Gate Tennis and Swim Club, be excluded from the deal.

"There is an ongoing struggle in the Barbary Coast neighborhood over an outsize condominium project usually known as the 8 Washington Project," Jonathan Middlebrook of the association’s Waterfront Action Group warned.

Friends of the Golden Gate chair Lee Radner, in a June 29 letter to Loni Hancock, chair of the Assembly’s Natural Resources Committee, argued for keeping lot 351 under the public trust because it "abuts the open recreational space, along the Embarcadero, Washington, and Drumm streets."

"Lot 351, if removed from the public trust," Radner wrote, "will give a developer the option to build high-rise, exclusive, and costly condominiums that would spill over into the recreational space and change the open view corridors to Telegraph Hill and Coit Tower forever, limit the light and views of many neighbors, and impact the traffic on an already congested Embarcadero."

But two local planning and land-use groups argue that Migden’s amended legislation would wrest control of height restrictions from the local planning process and benefit a well-heeled few at the expense of everyone else.

Tom Radulovich, executive director of Livable City, said he believes height limits and urban design should be decided at the local level. "The problem with stipuutf8g a 40-foot height limit is that you end up getting squashed retail space, creating a pokey, unpleasant atmosphere," said Radulovich, who’d rather see the lots taken out of the bill than included with those provisions. "To my mind the question is: how do builders create a great street? And what building controls help achieve that goal? We wanted to make these lots more walkable, bikeable, and accessible to contribute to the overall public good with the maximum opportunity for local control. The latest amendments tip the balance towards state interference, and that’s inappropriate."

Tim Colen of the Housing Action Coalition accuses the neighborhood associations of "not wanting any height increases or other uses to the extent that it might threaten their view." Colen said developer Simon Snellgrove of Pacific Waterfront Partners is interested in lot 351, which lies across from the Ferry Building, to create high-end condos, mixed-use residential units, and 34 below-market-rate units.

He acknowledges that the Golden Gate Tennis and Swim Club would lose three tennis courts under the legislation. "But this is a chance for 34 families to get housing and be able to stay in San Francisco," Colen said. "The Golden Gate Tennis and Swim Club is a really sweet facility, but it ain’t public recreation. Migden’s bill benefits some very well-heeled people when the interests of many are at stake."

Migden’s bill, which cleared the Senate but must return for final approval because of the amendments, is set to work its way through the Assembly by August. Benson said continued negotiations would be a good thing. "We appreciate Senator Migden’s work, but we believe height limits are a locals-only matter to be decided by the Board of Supervisors and the mayor."

But the Barbary Coast Neighborhood Association’s Diana Taylor said her group "spent hours getting the community informed, telling the port what we wanted, until eventually we came up with a bottom line, what our compromises were…. That’s where senator Carole Migden developed amendments, and this was the first time that we came to a coordinated agreement. But now we find out that the port isn’t happy with some of the amendments. What we’d like to see is a more clear-cut strategy to bring the port and the communities together. We’re adversaries right now, but we shouldn’t be."

With the port set to have a public discussion July 31 about lot 337 (the Giants’ parking lot next to Mission Creek), Jennifer Clary of San Francisco Tomorrow notes that Mission Creek is home to 60 species of birds. As she said, "Isn’t habitat preservation and restoration part of urban development? Is it really a choice between people and birds? Is that the decision?"<\!s>*

Problems with Peskin’s Muni plan

OPINION Last week the Board of Supervisors received a proposed charter amendment that takes a misguided stab at the much-needed reform of the Municipal Transit Agency, which oversees Muni. In undertaking reforms we all agree are needed for the MTA to better serve our city, the supervisors should consider the Hippocratic oath required of doctors: “First, do no harm.”

Our union, Service Employees International Union Local 1021, which represents almost a thousand MTA workers, has enormous respect for the bill’s sponsor, board president Aaron Peskin. We know that Peskin strongly supports workers’ rights and has always stood for openness, transparency, and accountability in government. This initiative, however, undermines everything that he and his board colleagues stand for, and we urge progressives to oppose it.

Most important, the initiative is profoundly undemocratic and would transfer oversight from an elected body to an appointed one. An MTA that no longer had to answer to our elected representatives would be a less accountable and less transparent board.

Downgrading elected oversight into appointive power resting in the hands of one person — the mayor — is not reform but a political power grab. Commissioners would be well aware that they might not be reappointed if they voted too independently of the mayor’s preferences.

The initiative would present additional risks for the abuse of power in local government by allowing MTA to approve its own contracts. This is a dangerous conflict of interest that would create more opportunities for problems, not reform.

The amendment furthermore would undermine workplace protections by increasing the number of nonunion workers from the current 1.5 percent to a whopping 10 percent. Working people would serve at the pleasure of an unelected board and lose their right to collective bargaining. Seven years ago many members of the Board of Supervisors and progressives strongly opposed a nonunion special assistant position in Mayor Willie Brown’s office. The board converted this position to a civil service job because of the perception of patronage and corruption. The current charter amendment exhumes that political cadaver while hiding behind the fig leaf of flexibility — which in this case is a code word for the power to fire people without just cause or due process, or for political expediency.

On one point we agree with this charter amendment: it’s true that the MTA needs more money to serve our residents the way it should, and this amendment would take $26 million from the General Fund and transfer it to the MTA budget. But we do not believe we should be raiding the General Fund without carefully considering the possible impact.

This is a charter amendment and cannot be easily undone. If it turns out to be a disaster, as we believe it will, San Francisco will find itself in a very dire situation without a timely remedy.

SEIU Local 1021 strongly opposes this charter amendment unless it undergoes major revisions. Sup. Jake McGoldrick’s competing initiative, by contrast, offers us a path that is much more democratic, promotes accountability and transparency in government, and protects the rights of working families. We agree that reform is needed, but if passed, Peskin’s initiative will create many more problems than it purports to solve. *

Green City: Winds of change

GREEN CITY Atop Bernal Heights, winds speed at 25 mph, enough to prematurely slam doors, disperse heat, and power Todd Pelman’s Roscoe Street house with 100 watts of electricity at any given moment.

The 34-year-old engineer has pioneered the city’s first permitted micro–wind project, a six-foot-tall cylindrical turbine that currently sits on his roof and sends juice into the energy grid, offsetting some of his dependence on Pacific Gas and Electric Co. Now his company, Blue Green Pacific, is working to put the turbines on the market in the next year.

"It’s aesthetically not going to be disruptive in an urban environment," Pelman told the Guardian, referring to the generator, which resembles the double helix of a DNA strand when it spins.

It is microprojects like this that could help support the Community Choice Aggregation program passed by the Board of Supervisors last month, which aims to have the city partner with its residents to generate a greener power portfolio over the next 10 years.

Bernal Heights Sup. Tom Ammiano, who codrafted a plan for CCA with Sup. Ross Mirkarimi, considers Pelman’s project a grassroots step away from PG&E, which he regards as a "wolf in sheep’s clothing."

"When people see how fruitful and utilitarian this is, we’ll wind up calling the shots," Ammiano told us. He amended the planning code for Bernal Heights to permit structures to reach more than 30 feet high, thus allowing the current and future use of wind turbines in his district.

Pelman’s turbine will generate between 300 and 600 kilowatt hours of energy per year, or about 10 percent of a typical home’s energy needs, he told us. His vertical-axis turbine is a natural propeller system that spins on its axis — a contrast from the windmill-style horizontal-axis turbines characteristic of rural areas. It’s made of steel, aluminum, and plastic and contains no sharp blades that might endanger birds.

Urban wind, though plentiful, has not been widely used, mostly due to aesthetics and the space constraints of turbines, according to Johanna Partin, the Renewable Energy Program manager of the San Francisco Department of the Environment.

"The micro– and small urban wind market is still in the early stages of development," Partin said, pointing out that Chicago, the notorious Windy City, only recently started a residential permitting process.

Pelman’s turbine became the first in the city to receive a residential permit for use last Oct. 5 after numerous bureaucratic back-and-forths with the Planning Department.

His rooftop turbine captures wind energy coming from the coast and going east and sends it to an inverter in his garage that converts it to usable energy, which then travels into an electrical panel.

"Think of the turbine as the heart of the system and the inverter as the brain of the system," Pelman said.

While Pelman’s turbine may catch people’s eyes, he claims it does not do the same to birds. "It coexists very peacefully with the pigeons and the hawks," he said, mentioning a couple of Bernal Heights’ bird species.

He is working with the Audubon Society to make sure he can live up to his assertion. Due to the turbine’s opaque appearance, no birds have attempted to fly through and meet their doom — a problem frequently noted with the large, horizontal-axis turbines at the Altamont Pass Wind Farm.

A one-turbine system will cost around $5,000, though Pelman estimates that rebates will reduce the price by $1,500. It’s an "emotional purchase," he said, that will at least partially satisfy a green conscience.

Chris Beaudoin, one of Pelman’s first customers, decided to make wind energy his green cause. His Castro home of 20 years — located on what he calls "consistently windy" Kite Hill — is one of the 10 sites where Blue Green Pacific will initiate beta testing in the next six to 12 months.

As a flight attendant whose job has opened his eyes to locations where governments are stepping up to the plate in renewable-resource use, Beaudoin realized that "we can either bitch about [the lack of renewable resources] or politically agitate for it."

Beaudoin takes the ominous signs of global warming as a reason to act fast in every plausible way that he can. As he told us, "I think the main motivation is that we have to be ready for what’s going on down the road." *

The San Francisco Ethics Commission is at an important crossroads, facing decisions that could have a profound impact on the city’s political culture: should every violation be treated equally or should this agency focus on the most flagrant efforts to corrupt the political system?

The traditionally anemic agency that regulates campaign spending is just now starting to get the staff and resources it needs to fulfill its mandate. But its aggressive investigation of grassroots treasurer Carolyn Knee (see “The Ethics of Ethics,” 7/4/07) — which concluded July 9 with her being fined just $267 — is raising questions about its focus and mission.

“For the first time in our history, we’re having growing pains,” Ethics Commission executive director John St. Croix told the Guardian, noting that the agency’s 16 staffers (slated to increase to 19 next year) are double what he started with three years ago.

Reformers like Joe Lynn — a former Ethics staffer and later a commissioner — say the commission should do more to help small, all-volunteer campaigns negotiate the Byzantine campaign finance rules, be more forgiving when such campaigns make mistakes, and focus on more significant violations by campaigns that seek to deceive voters and swing elections.

“The traditional thinking is there’s no exception to the law, and that’s been my traditional thinking too,” Lynn said. “But it doesn’t cut the mustard when you see a Carolyn Knee say, ‘I’m not going to do that again.'<\!s>”

At Knee’s June 11 hearing, Doug Comstock — who often does political consulting for small organizations — urged commissioners to reevaluate their mission. “Why are you here?” he asked them. “You’re not here to pick on the little guys.”

Yet St. Croix told us, “That’s not really the way the law is written. Everybody is supposed to be treated the same…. The notion that the Ethics Commission was only created to nail the big guns is not correct.”

That said, St. Croix agrees that regulators should be tougher on willful violators and those who have lots of experience and familiarity with the rules they’re breaking. And he said they do that. But it’s the grassroots campaigns that tend to have the most violations.

“It’s frustrating because the people who make the most mistakes are the ones with the least experience,” St. Croix said, noting that the commission can’t simply ignore violations.

 

A MATTER OF PRIORITIES

But critics of the commission say the problem is one of priorities. Even if there were problems with Knee’s campaign, there was no reason the commission should have launched such an in-depth and expensive investigation four years after the fact. That decision was recently criticized in a resolution approved by the San Francisco Democratic County Central Committee, which argued that the approach discourages citizens from getting politically involved.

“[The] San Francisco Ethics Commission spends an inordinate amount of its meager resources in pursuing petty violations allegedly committed by grassroots campaigns; this disproportionate enforcement against grassroots campaigns is directly contrary to the goal of the Campaign Finance Reform Ordinance,” one “whereas” from the resolution read.

The resolution’s principal sponsor, Robert Haaland, is intimately familiar with the problem. When he ran for supervisor in District 5 two years ago, his treasurer had a doctorate from Stanford and still struggled to understand and comply with the law. But they made a good-faith effort, he said, and shouldn’t be targeted by Ethics.

“It’s sort of like the IRS going after the little guy,” Haaland told us. “The commissioners need to set the direction of the commission for where they’re spending their time and resources.”

Eileen Hansen is perhaps the only member of the five-person commission to really embrace the idea that its mission is to help citizen activists comply with the law and to go after well-funded professionals who seek to skirt it. To do otherwise is to harm San Francisco’s unique grassroots political system.

“It’s true, the law is the law,” Hansen told us. “But I do think the Ethics Commission needs to grapple with how to apply the law in a fair manner.”

Is it fair to apply the same standard to Knee and to the treasurer of the campaign on the other side of the public power measure she was pushing, veteran campaign attorney Jim Sutton, whose failure to report late contributions from Pacific Gas and Electric Co. later triggered a $240,000 fine by Ethics and the California Fair Political Practices Commission, while those contributions might have tipped the outcome of the election?

Sutton gets hired by most of the big-money campaigns in town, such as Mayor Gavin Newsom’s, and has a history of skirting the law, including a recent case of allegedly laundered public funds at City College; coordination of deceptive independent expenditures against Supervisors Chris Daly, Gerardo Sandoval, and Jake McGoldrick; District Attorney Kamala Harris’s violation of her spending-cap pledge in 2003; and an apparent attempt to launder inaugural-committee funds to pay Newsom’s outstanding campaign debts (see “Newsom’s Funny Money,” 2/11/04). Yet the practice of the commission is to ignore that history and treat Sutton, who did not return calls seeking comment, the same as everyone else.

“We all admire and want grassroots organizations to do what they need to do,” Commissioner Emi Gusukuma said. But, she said, “the laws are there for a reason…. We’re supposed to enforce and interpret the law. The law should only apply to big money? The law has to apply to everybody. We can’t pick or choose.”

David Looman, a campaign consultant and treasurer involved in dozens of past elections, put it wryly. “Some people talk as though the grassroots campaigns shouldn’t have to obey the law,” he said of some activists he’s worked for who consider themselves the good guys. He said he reminds them, “This is the act that you helped pass, and now you gotta abide by it.”

“But there ought to be some kind of business sense here. Most regulatory agencies have offenses which they regard as de minimis,” Looman said, meaning “you get a nasty letter that says, ‘Don’t make a habit of it,’ and when you do make a habit of it, stricter penalties come into play.”

His experience with the commission has led him to believe there’s no sense of priorities when it comes to what Ethics pursues. Many of the small campaign committees Looman represents have been audited to what he feels is a ridiculous extent.

In one case, he told us, he took over the management of the Bernal Heights Democratic Club and discovered that it hadn’t been filing certain documents for years. He ended up paying $10,000 out of his own pocket to cover Ethics fines just because his name was now on the dotted line.

“Yes, the Bernal Heights Democratic Club was in complete violation of the law. They deserved to pay a penalty, but it was so far out of proportion. It was two times our yearly income. I think that’s inappropriate,” Looman told us.

 

THE GRASSROOTS CULTURE

Some say the whole idea of local campaign reform is to nurture an important and unique aspect of San Francisco: its vibrant and diverse grassroots political culture. “For every two committees in LA, there are three in San Francisco,” Lynn said, adding that it used to be a more extreme, two-to-one ratio. Larger cities often have more professionals involved, he said. “San Francisco has a unique political culture, very heavy on the grass roots.”

Yet the Ethics Commission doesn’t see protection of the little person as part of its mission.

“The fundamental problem with Ethics is it is not staffed by people who have been advocates for good government reforms,” Lynn said. “The Ethics Commission needs to come to grips with the fact that they’re tampering with the grassroots political culture of San Francisco.”

Lynn would like the commission to direct some resources toward hiring assistants to staff the office during the two or three weeks prior to Election Day, a crew that would help prevent violations and inoculate campaigns against being fined for errors that do occur.

“If you looked at the money that the Ethics Commission is spending going after citizen filers and reallocated it toward a staff of clerks, the cost to the city would be minimal,” Lynn said, estimating it at about $100,000.

Calling it the “H&R Block Unit,” Lynn thinks a staff of 10 to 15 clerks could be trained to assist small campaigns, individuals, and first-time filers who would come in and be walked through the complex paperwork.

St. Croix said such services are available now to inexperienced treasurers and those who ask for help — although not nearly as extensive as Lynn envisions — and he’d like to expand them in the future. But he said there are legal and practical complications to giving campaigns formal advice in letters that they might later use in their defense.

“I think it’s a lofty goal to educate people,” commission chair Susan Harriman told us. “We have staff with the sole job to keep people educated.” She said she’s attended meetings at which outreach occurred between the commission and community, but only as an observer. She thinks it’s the job of the staff to take an active community role, although St. Croix said that’s a resource issue.

Commissioner Emi Gusukuma thinks the appointed commissioners should be more involved. “I would be happy to be part of that team,” she said of joining any Ethics community outreach. “Going to clubs — I would definitely be willing to do that.” She noted that she and her fellow commissioners are all very busy, but she still thinks the educational aspect of their role is important.

Hansen also noted that a commission filled with relatively new appointees needs to hear more about the real-world impacts of its policies. “The public can educate the commissioners, and right now the commissioners are not educated on these issues,” Hansen said.

She and other reformers would like to see St. Croix facilitate a discussion of what the commission’s enforcement history has been and where the focus should be going forward.

“The perception is all we ever do is go after the small guys, but I don’t know if that’s really true,” Gusukuma said. She’s pushing staff to do more research into past enforcement actions “so we can tell the staff … not who to prosecute but what kinds of cases are important. We haven’t been able to get that analysis yet.”

Lynn said another key component in the education campaign would be to televise Ethics Commission hearings, which would help people become more engaged with the agency’s work. Commissioners Hansen and Gusukuma agreed, endorsing the proposal in this year’s budget cycle and winning the support of Sup. Chris Daly before he was ousted as chair of the Budget and Finance Committee, after which the expenditure (estimated at about $30,000 per year) was removed from the budget.

Harriman is opposed to televising hearings and thinks the money should be spent elsewhere. “I don’t think it’s a good idea. I think interested people who are interested in items on the agenda will appear. I think it’s a waste of city funds to televise something.”

Lynn said that attitude is the problem.

“The Ethics Commission doesn’t want to be televised, which is the reason to televise them,” he said. “They don’t want it because they’re trained that they are quasi-judicial and you don’t have cameras in courtrooms. Right now Ethics is invisible. The only way it can build a constituency is if it’s visible.”

Bob Planthold, another former commissioner, agreed. “Ethics doesn’t make friends,” he said. “It doesn’t have a constituency of positive advocates, and you need that at City Hall to get money and resources.”<\!s>*

 

Needed: a campaign against privatization

EDITORIAL Of all the cities in the United States, San Francisco ought to be most aware of the perils of privatization. Much of the city burned down in 1906 in part because the private Spring Valley Water Co. hadn’t kept up its lines and thus was unable to provide enough water for firefighting. A few years later, in one of the greatest privatization scandals in American history, Pacific Gas and Electric Co. stole what was supposed to be the city’s publicly owned electricity, costing the local coffers untold hundreds of millions over the past 80 years.

This is a city that votes 80 percent Democratic and has always opposed the Ronald Reagan–George H.W. Bush–George W. Bush agenda. A large part of the local economy depends on public employment (the city, the state, the federal government, and the University of California are by far the largest employers in town, dwarfing any of the biggest private-sector companies).

And yet Mayor Gavin Newsom, who likes to say he’s a progressive, is pushing an astonishing package of privatization measures that would shift public property, resources, and infrastructure into the hands of for-profit businesses. He’s talking about privatizing the golf courses, some city parks, and even Camp Mather. He’s promoting a tidal-energy deal that would give PG&E control of the power generated in a public waterway. He hasn’t lifted a finger to stop the ongoing PG&E–Raker Act scandal. And he’s determined to hand over a key part of the city’s future infrastructure to Google and EarthLink (see Editor’s Notes, p. 1).

This nonsense has to stop.

It’s hard to fight privatization battle by battle. Every single effort is a tough campaign in itself; the companies that want to make money off San Francisco’s public assets typically have plenty of cash to throw around. They’re slick and sophisticated, hire good lobbyists, and generally get excellent press from the local dailies. And it works: even board president Aaron Peskin, who generally knows better, is now talking about accepting the private wi-fi deal.

So what this city needs is a unified, organized campaign against privatization.

When Reagan arrived in the White House in 1981, the single biggest item on the agenda of his political backers was an attack on the public sector. The way the right-wingers saw it, government took money from the rich and gave it to the less well-off. Government regulated business activity, costing major corporations a lot of money. Government — "the beast," they called it — had to be beaten back, demonized, and starved.

So the Reaganites used their top-rate public relations machine to make the public sector appear riddled with waste and fraud. They cut taxes, ran up record (for the time) deficits, and forced Congress to eliminate a lot of social programs. More and more of what the government once did was turned over to the private sector — the way the radical right liked it.

That political agenda still rules Washington, D.C., where even a fair amount of the war in Iraq has been privatized, turned over to contractors who are making huge profits while Iraqi and American kids die.

The attack on government has worked so well that even a very modest plan by Bill Clinton to create a national health care system was killed by the insurance industry.

But privatization doesn’t work. Private-sector companies and even nonprofits don’t have to comply with open-records laws and can spend money (including taxpayers’) with only limited accountability. Most private companies are about making money first and serving the public second; that means when private operators take over public services, the prices go up, worker pay goes down (and unions are often booted out), and the quality of the delivery tanks. Look at the real estate development nightmare that has become the privatized Presidio. Look at the disgrace and disaster that the privatized Edison School brought to the San Francisco Unified School District. Look at the glitzy café and the pricey parking lot that have replaced good animal care at the privatized San Francisco Zoo. Look at what has happened around the world when Bechtel Corp. has taken over public water systems — rates have gone up so high that some people can’t afford this basic life necessity.

Look what’s happened to the American health system. Look what’s happened in Iraq.

Government isn’t perfect, and the public sector has lot of management, efficiency, and accountability issues. But at least the public has some hope of correcting those problems. San Francisco ought to be a place where a major movement to take back the public sector is born and thrives.

Almost everyone in town ought to have an interest. Labor, obviously, opposes privatization. So should neighborhood advocates (who care about public parks and open space), environmentalists (because the entire notion of environmentalism depends on a healthy public sector), progressive community groups, and politicians. Even more conservative groups like the cops and firefighters ought to see the need to prevent their jobs from being outsourced to a private vendor.

A campaign against privatization could link wi-fi, PG&E, tidal power, and the golf courses. The campaign could force anyone running for office to address a no-privatization pledge. It could appear any time one of these rotten schemes pops up in town — and send a message that San Francisco doesn’t accept the economic agenda of the radical right.

I don’t think anyone except Gavin Newsom’s inner circle and the folks who run Google and EarthLink really likes the mayor’s wi-fi contract, but it now appears at least possible that the Board of Supervisors will approve some version of it.

Board president Aaron Peskin wants the service improved a bit and is demanding some written guarantees that it will actually work the way it’s supposed to. Some opponents of the deal are arguing that it ought to be treated as a franchise, not a simple contract, and they want more legal hurdles. The serious techies say it’s the wrong technology anyway and will be outmoded and worthless in just a few years.

But there’s something bigger going on here.

A high-speed broadband system for San Francisco isn’t a hot dog stand and boat-rental shop in Golden Gate Park. It isn’t a restaurant lease on port property. It isn’t the naming rights for Candlestick Park or a permit to operate a taxicab or deliver cable TV.

Those are contracts and franchises. This is a piece of municipal infrastructure; it’s more like the roads that cars and Muni buses use to carry people around town or the pipes that bring water to our houses or the public schools that educate our kids or the emergency communications system that takes the call when we dial 911.

This is part of the city’s future, part of its economic development, part of how its citizens will participate in the political debate, part of how we will all learn and think and talk to each other. This is the new public square, the new commons.

Why in the world would we want to give it to a private company?

I don’t care if EarthLink and Google are offering 300 kilobauds per second of download time or 500 or 1,000. I don’t care if they promise to give free laptops to anyone who can stand on their head and shout "search engine." I don’t care if they promise to paint every light pole in the city green. They are private outfits set up to make a profit for investors. They have no business owning what will soon be the city’s primary communication system.

San Francisco has kept private operators from controlling its drinking water. This water is considered a basic part of life, and it’s available at low cost: San Franciscans pay less than one one-thousandth the price of bottled water for the stuff that comes out of the tap, and it’s almost certainly better. Same with roads and bridges, police and fire protection, and basic education (although that’s still a struggle).

I don’t get why broadband is any different.

I don’t think this would ever have been an issue 50 years ago. The generation that survived the Depression (with massive public-sector investment and ownership) and World War II (with huge excess-profits taxes on big corporations) and built things like the interstate highway system and the University of California didn’t see government as evil and inherently dysfunctional. The public paid to invest in public services.

It was Ronald Reagan and his ilk who took a generation disillusioned by Vietnam and Watergate and turned it against the public sector (see "Needed: A Campaign Against Privatization," page 5). Now we’ve even got a privatized war (and look how well that’s going).

The supervisors should get beyond the wi-fi deal’s little details and think about what it really means. This is San Francisco. We know better.<\!s>*

The City College loophole

EDITORIAL The 2000 law that made it easier for schools and college districts to sell bonds for capital improvements requires every agency raising money this way to create a citizens’ oversight committee to monitor spending. It also mandates regular audits.

But it’s a bit unclear what the audit requirement actually means — and as G.W. Schulz reports on page 15, that’s allowed some outfits, including San Francisco’s Community College District, to get away with spending hundreds of millions of dollars without proper accountability.

Some lawyers argue that school districts need only undergo perfunctory financial audits. Others say the law mandates detailed performance audits. This sounds like a minor point, but it’s not: financial audits only look at what was spent. Performance audits look at how and why — and whether the money was spent in accordance with what the voters were promised.

The City College administration is only now, reluctantly, agreeing to a performance audit, something that should have been done five years ago. The school’s lawyers say bond money can be freely shuffled from project to project, at any time, and there’s no need for regular performance audits.

There’s a simple way to clear this up: Attorney General Jerry Brown needs to issue an opinion on the intent of the law. And if he won’t do that or comes down on the side of unaccountable government, then the state Legislature needs to pass a bill mandating performance audits and requiring that bond proceeds actually go where the voters were told they would.

David Duer is proud of the volunteer work he’s done with the West Contra Costa Unified School District. He graduated from the area’s school system, as did his kids.

So despite what was sure to be a burdensome responsibility with no pay, Duer, a development director for the UC Berkeley Library, accepted the chance to serve on a committee formed under a state mandate to monitor how the district spent $850 million in bond money authorized by voters in three elections since 2000.

"There are schools all over the district that have been renovated," Duer beams today.

The committee initially proposed meeting every quarter but soon realized that wouldn’t be nearly enough to do the job right and chose to meet monthly instead. Since 2003 it has received full-blown management audits of the school system’s performance every year, with biannual updates from independent professionals not beholden to district bureaucrats.

The story of San Francisco’s Community College District could not be more different.

The oversight committee that’s charged with monitoring $560 million in bond spending has never seen an expansive performance audit, just basic financial reports that show community college officials here seem to be obeying their most fundamental fiduciary duties. The panel meets three times a year for more than an hour and a half each time, and for three years it didn’t even report to the public on City College’s handling of the money, which it’s required to do annually by the state’s Education Code.

The community college committee is hardly made of Rotary volunteers and bored retirees: the list includes San Francisco treasurer José Cisneros and former San Francisco Chronicle publisher Steve Falk, now head of the local Chamber of Commerce.

But even members say the panel has fallen down on the job — and that City College officials are freely shifting around the taxpayers’ cash with little or no accountability.

The mostly decipherable performance reports that West Contra Costa citizens receive, though lengthy, track all of that district’s bond expenditures and give the area’s oversight committee of taxpayers a vivid portrait of how well the school system and its administrators are managing hundreds of millions of dollars in building improvements. Any wonkish jargon in the reports that might mystify the committee is translated in "frank" terms by the outside inspectors, Duer says, without interference from school officials.

If a contractor were to double-bill the district or demand too much in change orders after promising completion within a set price range, Duer and his colleagues would know about it, and they could make suggestions on how to fix it. If the district was doing a stellar job, that would be clear too.

"I don’t see these performance audits as punitive," Duer said. "I see them as a confirmation that the process and systems in place are working."

MORE MONEY PROBLEMS


The Guardian reported last week ("The City College Shell Game," 7/4/07) that City College’s bond projects are running an astounding $225 million over budget. As a result, school officials have returned to the Board of Trustees five times in recent years to request that a total of $130 million be reallocated from one project to another to cover the overruns, leaving some projects promised to voters with little or no funding at all. We reported on a number of examples last week, but there are plenty more:

<\!s> The construction of a new Mission campus was supposed to begin in 2002 but didn’t get under way until well into 2005. The project is now $30 million over budget, an increase of 50 percent, and the school recently requested another $6 million diversion from other bond projects. City College originally planned to build the campus where a shuttered theater currently stands on Mission Street but later moved the site to avoid a showdown with preservationists.

<\!s> Since 1997, City College has asked voters for a total of $61 million to renovate and remodel existing buildings and meet Americans with Disabilities Act requirements. In November 2005 it asked voters for $35 million to perform such work, but just weeks after the election, $20 million of the money was reallocated to a planned Chinatown–<\d>North Beach campus that’s now running $50 million over budget, an increase of 60 percent. That project’s ever-changing design has been heatedly challenged by everyone from the Chronicle‘s editorial board to Sup. Aaron Peskin to state senator Leland Yee.

<\!s> Two projects for which voters authorized a combined $71 million won’t see the light of day unless the college returns to the ballot a fourth time, which school officials have discussed. The projects — a biotech learning center and a one-stop administrative shop for new students — have been drained of $42 million to save the Mission campus and an overdue Performing Arts Center, which will cost $75 million more than expected, an increase of 152 percent.

HUNTING AND PECKING


All of this irks Mara Kopp, who was appointed to City College’s oversight committee in late 2005 as a representative of the San Francisco Taxpayers Association. She’s complained openly that the school long ago should have hired auditors for the kind of far-reaching work West Contra Costa gets.

"If we received ongoing management reports, then we’d have something of substance," Kopp said. "We wouldn’t have to hunt and peck in a kind of naive, elementary way."

She is all but alone in her criticism, however, save for a small group of allies including former committee member John Rizzo and Milton Marks, one of the few voices on the independently elected Board of Trustees willing to apply tough scrutiny to Chancellor Phil Day’s office at board meetings. Green Party pol Rizzo recently became a trustee after closely beating longtime incumbent Johnnie Carter in the November 2006 board race.

Day has long argued that the school’s attorneys don’t believe such audits are required under Proposition 39, a 2000 state ballot measure that lowered the threshold for passing local school bonds. Prop. 39 required the formation of local citizens’ bond oversight committees.

Marks has questioned the strength of City College’s oversight committee and the lack of performance audits since at least 2005, but not until earlier this year were he and Rizzo able to force a resolution demanding the inspections, and now Day claims to welcome a management review. The school will bid out its first audit soon.

"The bottom line is, a performance audit as opposed to a financial audit would determine whether or not funds are being expended in the most efficient, effective, and economical manner instead of just adding up these funds and saying, ‘Here’s how much we expended and for what,’<\!s>" said Harvey Rose, a respected local auditor who’s reviewed city agencies and analyzed San Francisco’s annual budget for 35 years.

West Contra Costa concluded that Prop. 39 does require extensive managements audits. The committee even decided to include a $150 million bond election in 2000 in the scope of its work, although that wasn’t required, to ensure all the money was still being spent efficiently.

Duer said it doesn’t matter to him what the letter of the law requires. "It was always assumed with our work that this is something we had to have," he said.

The Los Angeles Community College District made the same assumption. Other districts statewide, however, appear to have interpreted Prop. 39 the same way City College has. And the Attorney General’s Office has never issued an opinion clarifying the matter.

Meanwhile, City College officials blame the millions of dollars in outsize project costs on inflation, a globally increased demand for steel and concrete, and slow-moving state regulators who must approve architectural designs.

"I understand both the college as well as the community would like to see us complete every single project we’ve proposed," Vice Chancellor Peter Goldstein told us recently. "We absolutely share that desire. The reality of cost increases has forced us to go back and look at our resources and reallocate in order to keep major projects going forward."

But Kopp and company argue that much earlier performance inspections would have revealed to the oversight committee and trustees where the increase in expenses came from with absolute certainty. That way, no one would have to rely exclusively on the glitzy project presentations made by Day and Goldstein that are often little more than slide shows with quotes from prominent business journals decrying the rising cost of construction materials. Trustee Marks has moaned repeatedly at board meetings that he doesn’t feel informed enough to vote on major reallocations, and his constant questions haven’t always made him popular.

"I think there’s this feeling that the board should not be adversarial," Marks said. "But I think by the nature of how things are set up, we have to be…. We have to look out for the best interests of the public at large."

Not everything’s rosy in West Contra Costa, of course. Anton Jungherr, a former San Francisco Unified School District official, sat on the West Contra Costa oversight committee for four years and fumed in an interview that the district didn’t take seriously the committee’s regular recommendations. He wants to form a statewide association of oversight committees to arm citizens with the information they need to track bond expenditures.

"There are legitimate reasons for change orders, but you have to analyze them and understand what the reasons are and then take the appropriate oversight action," Jungherr said.

But cost overruns in West Contra Costa still pale when compared with those at City College. Jungherr said that district has experienced about $100 million in unexpected costs on $850 million in projects undertaken since 2000, substantially less than what City College faces despite hundreds of millions of dollars more in bond projects.

Kopp still hopes City College’s oversight committee will build more muscle.

"If they were to show us documents they used themselves in monitoring all these things, that could substitute as long as the information was relevant and honest," Kopp said. "But it’s really been quite shallow all along."<\!s>*

Iraqi refugees who manage to make it out of Iraq still can’t work, have difficulty attending school and are not eligible for health care. Many still need to return to Iraq to escape poverty, according to BBC news.

I’m a muff-diving dyke, sort of. The first few times with my new girlfriend, I enjoyed her taste. However, most recently she tasted much different — and, frankly, worse. I almost blurted out that she might have a yeast infection (luckily I caught myself before completely ruining the mood). Curious, the other day I tasted myself, and I had a similar terribly pungent, unappealing taste. I know my body well enough to know I don’t have a yeast infection! So now I’m wondering, is it related to menstrual cycles? Previous physical activity? Sharing of bacteria and yeast?

Could be any of those, with yeast less likely since it doesn’t like sour things itself. Of course, I could be misinterpreting "terribly pungent" to mean terribly sour, or maybe you meant … OK, stop me there. See, this is why even proper medical personnel are discouraged from attempting to diagnose things in absentia — you don’t want them to do it wrong, and frankly, you don’t want me doing it at all.

The pH of the vagina does change over the course of the menstrual cycle, getting higher (more neutral) at ovulation, when the vagina welcomes sperm whether or not its owner thinks that’s a good idea (and whether or not there are any sperm present or expected, like, ever), and more acidic at either cycle end, when any sperm that wandered by would be doomed anyway, so we might as get it over with. The thing about menstrual cycles, though, is that they’re cyclic, so whatever she tastes like on, say, day twenty, she’d have tasted that way last month too. I’m not diagnosing, but I wouldn’t be surprised to hear you had a mild, mutual bacterial infection, but you’ll never know unless you get it checked out. You could sneak off discreetly and get fixed up, of course, but that’s not going to help her any, so, much as you might like to gloss this over in the interest of romance and mood maintenance, I’m afraid I can’t let you off that easily. You’re going to have to do the "Hey honey, I couldn’t help but notice …" thing, but hey, so what? It’s all in a day’s relationship work, is it not? And you are in one of those, are you not?

I ask because I couldn’t help noticing something myself, and unlike you I am not loathe to bring up uncomfortable truths, no matter how conversation-stopping. So hey, dudette, how come you could recognize your girlfriend in a blind taste test, while she wouldn’t know you from, you should pardon the expression, Adam? Is this lack of reciprocity part of some larger plan, or is she being kind of a piglet about this? And if it’s the latter, well, don’t you have more to talk about than who tastes nasty all of a sudden?

Dear Andrea:

My gyno prescribed estrogen cream (Estrace) to combat chronic yeast infections apparently brought on by vaginal dryness he says may be associated with my long-term use of the pill. He said it wouldn’t have any effect on my male sex partner, but then he also said an IUD was more effective than tubal ligation, so I don’t know whether to believe him. The Rx insert says nothing; the Mayo clinic suggests that estrogen cream could have an effect on my partner, and also that it is harmful to condoms (which we use in addition to the BCPs because I really don’t want kids). Plus, you know, there was that House episode a few weeks ago where a guy ‘s hormone cream seeped through his skin and made his kids sick.

Wow, really, there was nothing in the insert? Because while I couldn’t turn up anything superspecific, there is no question that the Estrace people themselves say to "avoid exposing your male sexual partner … by not having sexual intercourse right after using these medicines. Your male partner might absorb the medicine through his penis if it comes in contact with the medicine." Unless you’re both some kind of demented, round-the-clock, insatiable sex monkeys, it really shouldn’t be too difficult to figure out the time of day that you’re least likely to find yourself suddenly and spontaneously exposing your partner to conjugated estrogens, and apply the cream then. As for oral ingestion, dunno, but it should be equally avoidable. Apply in the morning, get head at night, or vice versa.

The creams are indeed harmful to condoms, just by virtue of being greasy, and I’m appalled that your doctor wouldn’t mention that, or any of this, really. He isn’t really wrong about the IUD, incidentally, but he’s very wrong not to mention sex when prescribing something you put up your lady parts. He may be wrong about more than that — any chance you could see somebody else? As for the doc on TV, well, I adore the show for the quips and the sexy crip, but you could get better medical information from This Old House or maybe Animal House. Estrace has a 1-800 line, you know.

Never mind the steampunk

TECHSPLOITATION If someone were to hold a knife to your throat and ask what the aesthetic sensibilities of the computer age are, you’d probably babble something about the iPod and its curvy, candy-colored precursor, the iMac. You’d think of the typical PC laptop, dumb and square and black, and you’d wonder whether this question about aesthetics was actually a trick. Because there are no computer age aesthetics.

Of course I’m exaggerating. There are a million interesting designs for consumer electronics and computers, but most don’t call attention to themselves. Computer aesthetics say "I am functional" — even the iPod Shuffle’s, whose colorful clip-on version kids attach to the gold chains around their necks as techno-bling.

But your Gateway computer, with its stalwart rectangular tower, is not the last word in how technology can look. Think of the crazy dial phones from the 1920s, with their curlicues and shiny brass and polished wood handsets. Or recall early radios, with their curving wooden exteriors meant to look like fancy furniture. And if you really want to see some seriously decorated machines, just check out pictures of devices from the 19th century, when everything from radiators to dynamos was covered in filigree and iron flowers and stamped, embossed shiny crap. For the record, I fucking love embossed shiny crap.

I think the search for an over-the-top tech aesthetic is driving the current craze for steampunk, a design and fashion style that combines Victorian sensibilities with contemporary gizmos. The ideal steampunk device would probably be a coal-powered cyborg, such as the creatures found in the novels of British fantasist China Miéville. In the real world, one of the most popular steampunk tinkerers is Jake von Slatt, who recently rebuilt his desktop computer as a vision in brass, marble, and old typewriter parts. He even offers a step-by-step guide to making your own functioning steampunk computer on his Web site, the Steampunk Workshop. Whenever von Slatt produces a new creation — a telegraph sounder that taps out RSS feeds, for example — pictures of it are always wildly popular on social news site Digg and elsewhere on the Web. Geeks who might not know what the word aesthetic means are instinctively drawn to the way von Slatt has made artifice from functionality. I expect to see cheap, knockoff steampunk computers for sale any day now.

As steampunkish critic John Brownlee has pointed out in several articles on the topic, steampunk designers tend to reverse-engineer ordinary electronics — say, a computer keyboard — and enhance them with parts that look antique. The idea is not just to create machines whose beauty goes beyond functionality. It’s also, Brownlee contends, to recall an era when amateurs could contribute meaningfully to the development of science and technology. We live in a time when no single human being can fully comprehend the Windows operating system. No wonder we’re nostalgic for the days when beachcombers could be naturalists and tinkerers could invent the telephone.

I think the popularity of steampunk also expresses our collective yearning for an era when information technology was in its infancy and could have gone anywhere. In 1880 we hadn’t yet laid the cables for a telephone network, and computer programming was just an idea in Ada Lovelace’s head. Nineteenth-century technology was often operated by factory laborers, and it meant backbreaking work and the ruination of healthy bodies. Information technology, to the 19th-century mind, would be something that set us free from brutal assembly lines.

One hundred years later, I wish it were so. Information technology has its own brutal assembly lines, mind-numbing data work that cripples our fingers with repetitive strain injuries and mangles our backs with the hunched postures required to work at a computer all day long. Seen from this perspective, steampunk is an aesthetic that tells the truth about us. We are no better off than our Victorian ancestors, bumbling into the future with crude technologies whose implications we barely understand. But let’s make our devices pretty, at least. Let’s remember the days when the machines that now cage us promised liberation. *

Citizen planning

The Eastern Neighborhoods Plan has become a high-stakes battleground involving anxious developers stalled by a temporary building moratorium, progressives who want more affordable housing, concerns about dwindling light-industrial spaces and an exodus of African American residents, environmental justice, and a list of other issues that are central to this sprawling section of the city.

But the folks in the neighborhood known as Western SoMa are just happy that they’re no longer a part of that mess. Instead, they’re excitedly experimenting with a new approach to planning using an innovative and largely untested grassroots model.

Five years ago, when the city Planning Department first announced its intention to rezone the Eastern Neighborhoods, a group of disenchanted SoMa residents decided that they wanted to secede from that process and develop an independent, more comprehensive, community-based plan.

"A lot of us were offended by the Planning Department’s top-down, autocratic process," Jim Meko, who later became chair of the Western SoMa Citizens Planning Task Force, told the Guardian. "It was a bad process for everybody, but it was particularly bad for SoMa because the neighborhood had already been rezoned in the 1990s."

Meko survived three major demographic shifts within three decades: the AIDS epidemic that decimated SoMa’s gay community, the live-work loft zoning loopholes that gutted the artistic community, and the dot-com crash that displaced many techies. He feared that the Eastern Neighborhoods Plan would impose a "one-size-fits-all mode that treated all of SoMa like postindustrial wasteland."

So Meko set his sights on pressuring the Planning Commission to split his neighborhood from the rest of the Eastern Neighborhoods, which include the Mission District, Eastern SoMa, Showplace Square, Potrero Hill, and the Central Waterfront. Western SoMa is bordered by Mission and Bryant, 13th and Fourth streets, and Harrison and Townsend.

That dream became a reality in February 2004, and that November the Western SoMa Citizens Planning Task Force formed, with a stated objective to "recommend zoning changes that will preserve the heart and soul of their neighborhood, while planning for the realities of 21st-century growth."

Since beginning its work in 2005, the 22-member task force has met as often as five times a month and has created a values statement; a set of planning principles; committees focusing on business and land use, transportation, and arts and entertainment; and a committee that integrates a variety of issues.

Its June 28 town hall meeting was the first time the task force threw the doors open to the community at large, although the occasion happened to come on the heels of a high-profile budget battle between Mayor Gavin Newsom and Sup. Chris Daly, whose district includes SoMa and who helped set up the task force.

Within five minutes of Meko’s kicking off the meeting, a small but vocal group of attendees began to heckle him midspeech. Perhaps they were there to confront Daly, who had been slated to attend but was out of town. Whatever the reason, while accusing Meko of "having an agenda" and "using the bully pulpit" to present his own views, this faction was anxious to know how many task force members are property owners and which particular group of them would be dealing with crime, the fight against which Newsom has made a top budget priority.

For one wobbly, tension-filled moment, it felt as if this first crack at a citizen planning forum might crumble. But then another participant saved the day by requesting a simple but basic meeting ground rule: no personal attacks.

From that moment, the mood in the room lightened. Pretty soon the rest of the 150 residents who had gathered in the multipurpose room of Bessie Carmichael School on Seventh Street to share their thoughts on Western SoMa were talking about what they liked and what could improve. Even the hecklers quieted down and seemed to meld into the discussion.

As Planning Commissioner Christina Olague put it at the meeting, "This is possibly one of the most exciting things going on in planning. No one understands the heart and soul of a neighborhood like the people who live there. We hope this is a model other neighborhoods will adopt, because a neighborhood plan without the involvement of neighbors who live and breath a community is chaos — just a bunch of buildings zoned in a language no one can read or feel."

But while residents were happy to create lists of neighborhood needs — more parks, bike lanes, affordable housing, child care facilities, and trees; wider sidewalks; and fewer homeless people — they were less keen on the idea of increasing building heights. One proposed means of financing improvements would be to increase allowable heights from 40 to 65 feet in some places.

Some locals complained about partygoers who urinate in the streets and play music loudly in cars instead of going home when the clubs close. But a youthful resident politely pointed out that "it may not be possible to stop young people from being young."

In the face of requests from senior citizens for more dinner theater and fewer nightclubs in SoMa, task force member and nightclub owner Terrance Allen observed that it’s probably only possible to "nudge existing conditions."

Recalling the battle that broke out between residents and partygoers after city planners decided to put affordable housing next to the wildly popular nightclub 1015 Folsom, Allen said, "You don’t want to start a war by putting subsidized housing next to the city’s biggest nightclub." Or as Meko put it, "We don’t want to set up conflicts by putting family housing across from the Stud."

By evening’s end, the consensus was that the meeting was a success. "We have much more in common than we have apart. That’s the whole key," said Marc Salomon, who sits on the task force’s transportation committee. As Meko told the Guardian the next day, "Wasn’t it a fantastic experience? It was the closest thing to a cocktail party without a bartender."

Meko said the task force is eager to complete its work and is shooting for having a draft plan ready by the next town hall meeting, on Oct. 24.

"But we need to do more community outreach," he added, noting that there weren’t many Filipinos at the first meeting even though they have a large presence in Western SoMa. "We’re looking at what SoMa could be like in 20 years. The other Eastern Neighborhoods are watching, and they are envious." *

The truth about housing money

OPINION Just as in war, in 2007 San Francisco budget politics, truth is the first casualty.

Nowhere is this more obvious than in the assertions by Gavin Newsom’s campaign minions that the mayor’s current budget proposal contains a $217.5 million city investment in affordable housing.

The purpose of these claims is to imply that Newsom has voluntarily allocated local tax dollars for this critical need — and that no more should be spent on affordable housing, especially some $10 million for lower-income rental housing production for families with children proposed by Supervisor Chris Daly and the Board of Supervisors.

The facts tell a different story.

First, the impression that this $217.5 million is all local tax money the mayor has voluntarily invested in affordable housing is false. Some $20 million is federal and state money that can be spent only on affordable housing. Another $25 million comes from local sources and also must be used for affordable housing. And $48 million comes from tax-increment funds mandated by a 2005 supervisors policy to go solely toward affordable-housing development.

So about 40 percent ($93 million) of the affordable-housing funding that the Mayor’s Office talks about was money that by law had to go to affordable housing. It wasn’t Newsom’s choice.

Nearly a third of the mayor’s budget for creating affordable housing — some $60 million — is in fact allocated to fund his Care Not Cash program, which was supposed to pay for itself. Indeed, more than twice as much money, $31 million, is earmarked to pay for privately owned, leased residential hotel rooms for temporary housing of the homeless (not producing one new affordable home) as is budgeted for the production of new, permanently affordable lower-income family rental housing ($15 million). The fact is, the 2007–08 Newsom budget cuts $24 million in funds earmarked for new affordable-housing production for families and seniors.

What is most distressing about the half-truths and nontruths in the affordable-housing budget battle of recent days is that the unity between the mayor and the Board of Supervisors — crucial to the expansion of affordable-housing opportunities for San Franciscans and which has characterized the city since the George Moscone administration (some 25,000 permanently affordable homes have been produced in the past 20 years, a figure unmatched in any other mayor American city) — has been placed in peril for short-term political advantage.

But cooler heads have prevailed inside and outside City Hall. Sometimes it is better to shut up and do what needs doing and let the credit fall where it may.

Which is why, when the dust settled last week, no one shouted about the $10 million that was quietly added back into the budget for permanently affordable family-housing production.

But we should all be clear: if we want San Francisco to be as economically diverse as we all claim, then we have only just begun to find the funds needed for more affordable housing. While it may or may not be true that you can never be too rich or too thin, it is most certainly true that San Francisco never allocates enough for affordable housing. *

Green City: People versus death monsters

GREEN CITY Pedaling or walking along a Panhandle pathway is the essence of green, a simple act of sustainable living and connection to a natural area within an urban core. It’s a calming, transformative activity — at least until you get to Masonic Avenue and the telling words painted on the path: "Death Monsters Ahead."

The death monsters, a.k.a. automobiles, that bisect this three-quarter-mile-long green runway into Golden Gate Park would be jarring even if traffic engineers had made that intersection the best it could be. Instead, it’s closer to the opposite — dangerous, illogical, and frustrating for all who must navigate it, a testament to what happens when the primary intersection-design criterion is moving cars rapidly.

After getting word of a rash of bicycle- and pedestrian-versus-car accidents at the Masonic-Fell intersection in recent months, Walk SF and the San Francisco Bicycle Coalition reinitiated (two years ago, it was the same story) a voluntary crossing-guard program on Saturdays and weekday evenings and lobbied City Hall to finally do something.

Sup. Ross Mirkarimi took up the cause, announcing at the June 26 Board of Supervisors meeting, "I find it simply unacceptable that the city has ignored the problem to the point where a volunteer program has become imperative. Traffic safety is a baseline city responsibility."

Mirkarimi is asking the San Francisco Municipal Transportation Agency, which has responded to years of complaints about this dangerous intersection with only minor and ineffective tinkering, to finally make a substantial change. He and the activists want a dedicated signal phase for pedestrians and bikes and a dedicated left-turn lane for cars coming off Fell.

It doesn’t take a traffic engineer to see what’s wrong with this intersection. Cars trying to turn left onto Fell from busy Masonic regularly get stranded by a red light and are stuck blocking the crosswalk. Even more dangerous is when bikers and walkers cross on their green light only to find cars — which also have a green light — turning left from Fell Street, cutting across their path.

The problem is vividly illustrated with too much regularity. I can still picture the female bicyclist who flipped through the air and crumpled to the ground a few feet from me after getting hit hard by a motorist. It was almost three years ago, but it remains a vivid, cautionary memory.

I was riding my bicycle west on the Panhandle trail, even with the motorist. Our eyes locked, his anxious and darting, and I knew he might try to cut me off, so I slowed. Sure enough, the driver made a quick left in front of me and hit the bicyclist coming from the opposite direction, who assumed that the green light and legal right-of-way meant she could continue to pedal from one section of parkland to the next. Instead, she joined a long list of Fell-Masonic casualties, to which attorney Peter Borkon was added May 19, a few days shy of his 36th birthday.

Borkon was on his road bike, training for the AIDS Life Cycle ride, when he cautiously approached the intersection, slowed, and unclipped from his pedals. When the light turned green, he clipped in, crossed into the intersection, and then, he says, "I was run over by a Chevy Suburban."

He was hit so hard that he broke his nose and gashed his face on the car, an injury that resulted in 15 stitches, and was thrown 10 feet. The fact that he was wearing a helmet might have saved his life, but he nevertheless went into shock, spent a day in the hospital, and is still waiting for the neurological damage to his face to heal.

How dangerous in that intersection? When I asked the MTA for accident statistics, a response to the criticisms, and a plan of action, public information officers Maggie Lynch and Kristen Holland first stonewalled me for two days and then said it would take two weeks to provide an answer.

Maybe Mirkarimi will spark a change, or maybe the MTA will just keep doing what it’s always done: plod along at a bureaucratic pace with tools ill suited to an evolving world that must do more to facilitate walking and bicycling as safe, attractive transportation options, even if that means delaying the death monsters.*

The golf club

For the better part of a century, San Francisco’s public golf courses have offered players relatively inexpensive rates, belying the view of some that this is an elitist sport incompatible with progressive civic governance. But since a botched revamp of the Harding Park course several years ago, golf operations have landed in the rough, siphoning large sums from city coffers every year. Now Mayor Gavin Newsom and his Recreation and Park Department claim that private businesses would do a better and cheaper job of running three of the city’s most valuable links.

Sup. Jake McGoldrick and other privatization opponents say outsourcing control of the Harding, Fleming, and Lincoln courses would inevitably lead to less access for the general public and higher costs. "A lot of folks don’t realize that the Golden Gate Yacht Club and the St. Francis Yacht Club are public assets that are now run as private membership clubs, elitist things," McGoldrick told the Guardian. "That’s certainly the way this could go."

McGoldrick has called for the formation of a Golf Course Task Force to explore nonprivatization solutions, including converting some of the courses into parks or open space, as the Neighborhood Parks Council has urged. On July 10 the Board of Supervisors will decide between McGoldrick’s plan and Rec and Park’s "hybrid management" resolution, which would award leases of 20 to 30 years for the courses. Political handicappers say the vote could go either way.

In addition to their concerns about prices and accessibility at privately run links, McGoldrick and others have serious reservations about who will run the courses if the mayor’s plan succeeds. No one we spoke with could name potential bidders with any certainty, but if the past is prologue, the choice is likely to involve political cronyism.

Golf advocate Sandy Tatum engineered the deal that turned Harding Park over to the management of Kemper Sports, which has been accused of overspending public funds and turning the course into a huge drain on the city treasury. Kemper also rents space to Tatum’s First Tee program. More recently, another nonprofit started by Tatum and former city attorney Louise Renne initiated and funded a study for Rec and Park that recommended more privatization by turning over courses to entities such as theirs.

The SF Weekly, which has run stories critical of the city’s golf privatization scheme, revealed a 1990s deal that privatized a city-owned course near Burlingame and, in what it deemed a corrupt selection process, handed control of the course to former Willie Brown staffer Tom Isaak.

In 2004, Tom Hsieh, one of Newsom’s key campaign consultants, submitted the sole bid for control of Gleneagles Golf Course in McLaren Park. Neither Hsieh nor his business partner, real estate investor Craig Lipton, had ever run a golf course before winning the contract for Gleneagles. But what really raised eyebrows around City Hall were the terms of the deal. Any lease of more than 10 years would have needed approval by the Board of Supervisors, so Hsieh and Lipton were given a nine-year contract.

"That was a very obvious and blatant end run around the contract requirements of the Board of Supervisors," McGoldrick told us. Hsieh, he went on to say, "is one of the mayor’s good buddies, and he got himself a nice contract out there."

Rec and Park spokesperson Rose Dennis defended the lease agreement with Hsieh, telling us, "At the end of the day, he legally got the concession. It wasn’t like it was put down to a nine[-year contract] to screw anybody. That would suggest a level of sophistication that Rec and Park just doesn’t have."

Reached for comment, Hsieh bristled at the suggestion that he landed the contract because of his ties to the mayor, writing in an e-mail that the mere suggestion was "a scurrilous attack motivated by politics." Hsieh did not answer our repeated requests for information about wage levels at the Gleneagles course and the number of groundskeepers employed there. McGoldrick and sources in the industry assert that one of the main ways private managers would make money from the other courses would be to reduce labor costs.

Sup. Sean Elsbernd, one of the privatization plan’s strongest backers, conceded that some past golf contracts have been "questionable," specifically in the case of Hsieh’s deal. But he said the supervisors would oversee the leasing process this time to avoid cronyism and the kind of spending excesses allegedly committed by Kemper Sports. They would also mandate that new managers continue to employ union employees.

Unlike the city, Elsbernd argued, private businesses could invest large sums of money in rehabilitating the courses, especially Lincoln. "When it gets that kind of [cash] infusion," Elsbernd said, the course "is going to see a turnaround in revenue so that you can actually justify charging higher fees."

That is exactly the kind of scenario privatization foes fear: more exclusive golf courses on public land that raise greens fees beyond ordinary people’s means. "These courses are untapped gold mines," said golf instructor, former pro, and activist Justin Hetsler, who has formed a nonprofit group, Golf San Francisco, to lobby against the mayor’s plan. "But every penny spent at the courses should go back into them, not into someone’s pocket as profit." As for capital improvements, Hetsler, who also works as an accountant, argued, "The courses’ future revenue streams can secure credit for improvements. That does not require privatization."

For McGoldrick, this debate is about far more than golf courses. "I don’t even play golf," he told us. The push to outsource control of the links, he said, reflects a larger philosophical battle about what to do with publicly owned resources. "The mayor is a pro-privatization kind of guy. That’s his MO…. We’re seeing this happen all over the place, not just San Francisco. But for me, it’s just painful to watch city assets [be] given away. It really kicks me in the gut." *
