Meat the Figurines

I have a meat map of the world in my head, so when I hear "Denmark," I think of ham. If I think a little harder, I’ll come to kringle, that delicious pastry that’s ubiquitous in Racine, Wis., which is the closest I’ve come to Denmark.

My baby-momma’s of Danish descent, so I also think of the time her cousins came to visit and were amazed by the size of American freeways and our unnatural attachment to firearms. This quaint yet magical mental landscape of cured swine and fatty pastry treats is peopled by friendly — that is to say, unarmed — round-faced folk in wooden shoes, riding horse-drawn buggies down narrow lanes. (The arboreal footwear, which is Dutch, not Danish, and the stray Amish buggy are figments of my somewhat limited imagination, but it’s my quaint vision, so fuck you.) This place has a subtle, subdued soundtrack: When the Deer Wore Blue (Morningside/Control Group, 2007), by Figurines.

The band’s been around since the mid-’90s, when three plucky and puckish teenage Danes by the names of Christian Hjelm, Andreas Toft, and Claus Salling Johansen grew tired of their apprenticeships at their fathers’ respective pig farms and started jamming out on guitars. Together. Three guitars. Which portended a future in a Danish black metal outfit–cum–Motörhead cover band called Thunderfoot–cum–Glenn Branca guitar chamber ensemble, which never came to pass, as Toft moved to bass and Johansen, his arms sinewy with muscle from pounding pig flesh in Papa’s processing plant, decided on drums. What followed was the self-released 2001 EP The Detour and a 2003 debut long-player, Shake a Mountain (Morningside), which was never officially unleashed on the gun-toting psychopaths stateside. Figurines added drummer Kristian Volden, and Johansen and his ham hands — sorry, can’t help it — moved back to guitar. Their burgeoning pop stardom brought them bushels of free ham and kringle and, inexplicably — except in the context of this ridiculous yarn — truckloads of hot chicks in wooden shoes. The boys bought the fastest horses on the lane and had them augmented with pinstripes, flame jobs, and bigger hooves in the back.

The year 2005 brought a daring daylight raid on the John Wayne–ophile Huns in the dark, dystopian land of America with the global release of Skeleton (Morningside/Control Group), which I discovered on my desk between 100 mph drive-by-shooting runs in my stroked-out Dodge Challenger hemi, done out in General Lee orange with a giant rebel flag painted on the roof, natch. As Hjelm sings on Skeleton‘s "Ambush," "Chase ’em down because you’re angry." The band drew comparisons, by other music writers with imaginations even more taxed than mine, to indie giants Built to Spill and Pavement. The Built to Spill thing makes sense, as Hjelm’s voice does have a nasal quality like Doug Martsch’s, but the Pavement allusion I can’t figure, except to say that when music writers get a really good pop record and want to blow smoke up a combo’s collective arse, they trot out left-field comparisons to Stephen Malkmus and company instead of inventing lands of ham and horses. I don’t know — maybe there was something there rhythmically.

For Deer, Figurines have replaced Toft on bass with Mads Kjaergaard, formerly a wood nymph, after the former left the band to open a drive-through guns and alcohol store on an American Indian reservation on Route 666 in Arizona. What can I say? After touring the States, he grew dangerously enamored of our culture. Perhaps more important than this — really, unless they’re Lemmy or Jaco Pastorius, there’s not a lot of change when you switch bassists — they added Jens Ramon on keyboards, which is perhaps the single biggest mood changer on the new disc. Deer has an eerie yet upbeat, cinematic feel to it. It could serve as an alternate to Air’s The Virgin Suicides soundtrack, if the movie had a different ending in which the sisters didn’t kill themselves but instead moved to Denmark to shack up with an indie band — and then killed themselves. "What if we had a chance?" Hjelm sings on "Childhood Verse." "I promise together we’ll die."

Hjelm goes on to channel Brian Wilson in "The Air We Breathe," which, with its backing harmonies, sounds like an outtake from the Beach Boys’ Pet Sounds (Capitol, 1966). On "Good Old Friends," Neil Young comes to mind: "Not sure what to leave behind / But I know we’ll be all right," Hjelm sings, the phrasing and sentiment feeling like Young’s line in "Tell Me Why": "Is it hard to make arrangements with yourself / When you’re old enough to repay but young enough to sell?" From here the band moves on to "Drunkard’s Dream," which opens with a sort of indie-ized send-up of Stevie Wonder’s "Superstitious," though the metronomic snare hits contrast with the funky guitar lines, making the track more akin to art rock à la Television than Wonder funk. "Bee Dee" centers around an "up the stairs and down again" guitar riff and has a looser, Feelies vibe, while the keyboards in "Cheap Place to Spend the Night" move from rollicking Farfisa to tinkling celesta.

Overall, while conceptually satisfying, the cinematic feel of Deer is not quite the pure pop bliss of Skeleton. Maybe it’s a bit homogeneous, rife with ethereal keys and moody vocals. Maybe our Danish Fab Five have been influenced by the resurgence of folk. The back-cover photo is a cross between a Little House on the Prairie still and a Flying Burrito Brothers portrait, sans rhinestone suits: two Figurines are wearing suspenders, and they each have a questioning, somewhat obsequious look on their face, like they’re about to collectively ask, "Howdy, stranger, can we get you a sarsaparilla?" But the record is ambitious, signifying the band’s willingness to change its sound with each release and not just hammer on what’s worked in the past. From their humble beginnings in ham shanks and clog dancing, Figurines dream big — bigger than I do, certainly.

Being named journalist of the year is a significant distinction. It’s just too bad that Chauncey Bailey isn’t around to receive the award.

The Northern California Chapter of the Society of Professional Journalists named Bailey the winner of its top award Sept. 21, citing his "his fierce commitment to investigative journalism in the face of personal danger."

"At a time when journalists around the world are under threat for simply doing their jobs," the group said in a statement, "Bailey was a forceful presence in print and on radio and television in the Bay Area for the past 15 years. A tireless advocate for the African American community, he was assassinated while pursuing a story, and evidence presented thus far shows that he was assassinated because he was pursuing that story."

The longtime reporter and editor was shot to death Aug. 2 at the shady intersection of 14th and Alice streets in Oakland. That intersection, the site of Bailey’s Oakland Post office, sits in the center of the city’s power structure, with county court and government office buildings situated nearby.

An employee of Your Black Muslim Bakery — a group that has a history of both political influence at Oakland City Hall and severe money woes, which Bailey was investigating — is accused of shooting Bailey twice in the chest and once in the head with a black Mossberg shotgun as Bailey walked to work at the Post.

Devaughndre Broussard, the 19-year-old alleged shooter, was arrested during a raid at four locations, including the bakery’s main address, following the killing. Also arrested in the raids were three other people associated with the bakery and political movement; they were charged with kidnapping and torture following an earlier incident.

At the center of this story is the family of the late black Muslim leader Yusuf Bey Sr., who maintained a violent fiefdom now linked by law enforcement officials to an alleged assassination, vigilantism, child rape, and the abuse of a disadvantaged-business loan to the Bey family and its associates, as earlier media accounts and criminal charges revealed.

Police say they caught Broussard tossing a black shotgun out the window of a 59th Street address during one of the raids and that he admitted the gun belonged to him. Police have told the media that shells found at the intersection where Bailey was killed were linked to the gun.

But Broussard’s attorney has waged a public campaign to prove that Broussard wasn’t the assailant. The Oakland Tribune, where Bailey once worked as a reporter, has reportedly obtained police notes from interrogations that contained details of an unrecorded conversation between Broussard and Yusuf Bey IV, heir to the bakery chain and the black liberation movement that surrounded it.

Broussard’s attorney has insisted that Bey IV, during that brief exchange, coaxed Broussard into confessing to the murder. Broussard later did exactly that and reportedly claimed he pulled the trigger because Bailey was investigating the bakery’s deteriorating finances, which grew worse after Bey IV took over as CEO.

In mid-September, Alameda County reached a $188,000 settlement with three women who filed suit alleging that Bey Sr. assaulted them after local child welfare officials placed them in his custody. The three women first claimed in 2003 that Bey Sr. defecated on them and forced them to have sex with him and drink his urine and semen. But Bey Sr. died of cancer that year before he could face related criminal charges in court.

Bailey joins the growing roster of international journalists attacked or killed for reporting the news. On Sept. 27, Japanese photojournalist Kenji Nagai, who was working for the French news service Agence France-Presse, was shot to death by Burmese troops as they assaulted demonstrators in an increasingly bloody suppression of dissent still taking place in that country.

Reporters Without Borders notes that 75 journalists were killed worldwide in 2007, triple the number in 2002. Fifteen were killed in the Americas, according to the Inter American Press Association, which is preparing a resolution on Bailey’s death.

In early August two dozen Association of Alternative Newsweeklies newspapers published a story written by longtime Guardian Mexico City correspondent John Ross (and edited by the Guardian) outlining the events that led up to the shooting death of videojournalist Brad Will in Oaxaca, Mexico, during social and political unrest in the fall of 2006.

Gonzalo Marroquín, chairman of the IAPA’s Committee on Freedom of the Press and Information and editor of the Guatemala City, Guatemala, newspaper Prensa Libre, stated in early August, "We urge the authorities to investigate the [Bailey] murder in depth and promptly, so that the case does not become just another on the list of unpunished crimes in the Americas."

Guards hit streets

More than 100 security guards from more than 20 buildings in the Financial District, including the Transamerica Building, participated in a three-day unfair-labor-practices strike before returning to work Sept. 27 as contract talks resumed.

After three months of working without a contract, security guards are seeking higher wages and access to affordable health care to be able to support their families, as well as proper training for the safety of buildings and their occupants.

Service Employees International Union Local 24/7 representatives were mostly pleased with the job action, although the union had to defend three guards who were locked out as the strike ended. Universal Protection Services had planned to permanently replace security officers Robert Ravare, Kevin Coleman, and Jesusa Villena, but the issue has since been resolved, and the three employees returned to work on the morning of Sept. 28.

Abbas Emady, a security guard for Universal, told the Guardian he resents security companies for not providing adequate training for their employees, which devalues the important role guards are likely to play in a disaster. And low wages and poor benefits exacerbate the problem by creating high turnover rates for guards.

"If there’s a terrorist attack or a fire, we’re the first to go," said Bobby Randall, who works for Securitas as a security guard at the 50 Fremont high-rise. Without sufficient training, security guards may have difficulty assisting police and firefighters in an emergency, a point the local police and firefighters unions reinforced with votes of support for the strike.

Security guards risk their lives to protect multibillion-dollar properties, yet they don’t receive the same wages or health coverage as janitors, window washers, parking attendants, or operating engineers who work in the same buildings. In fact, a security guard with two and half years of experience only makes $11.85 an hour, while a janitor with the same experience makes $17.05 an hour, according to the SEIU. A union-run "Justice for Janitors" organizing campaign a few years ago helped that group make progress.

"It’s an unacceptable double standard," SEIU Local 24/7 spokesperson Gina Bowers said.

Armando Yepez, who participated in the strike, told us he works two full-time jobs as a security guard, at a downtown high-rise and at a construction site, in order to pay for housing and other expenses. Yepez commutes between his home in Richmond and his job locations in San Francisco five times a week, leaving him with less than five hours of sleep each night.

Security officers often find themselves paying for medical expenses out of their own pockets because their health insurance does not cover all of their needs and does not provide family benefits.

On Jan. 1 security guards were offered a free but severely limited health plan with Aetna, which has a cap of $4,000 for outpatients. For Sue Trayling, a security guard working for Securitas, all it took was one night in the emergency room and a couple of doctor’s appointments to max out her Aetna plan. Trayling clocks in 421/2 hours a week yet still had to dish out $2,400 in cash to pay for additional medical expenses.

According to Trayling, security guards were offered health care plans with Kaiser Permanente for $26 per month before Jan. 1. Since then, however, premiums have gone up to about $140 per month, and the copayment has doubled from $20 to $40 per visit.

The first strike among private security officers in San Francisco found some official support — the Board of Supervisors passed a resolution Sept. 25 in favor of the security guards. Sup. Tom Ammiano stood before a small crowd of workers clad in purple T-shirts on the steps of City Hall and expressed the city’s support for higher wages, affordable health insurance, and proper training.

Mayor Gavin Newsom also issued a statement saying, "I urge the involved parties to work more diligently towards a fair and reasonable settlement — one that recognizes the economic concerns of the workers while at the same time respect[ing] the employers’ need for operating flexibility within the wide range of facilities in which they provide security services."

Newsom also asked commercial-building owners and managers to involve themselves in the negotiation process with the security companies in order to set new industry standards. The Building Owners and Managers Association did not return our call seeking comment on the strike and related issues.

Endorsements: Local ballot measures

Proposition A (transit reform)

YES


This omnibus measure would finally put San Francisco in a position to create the world-class transportation system that the city needs to handle a growing population and to address environmental problems ranging from climate change to air pollution. And in the short term it would help end the Muni meltdown by giving the system a much-needed infusion of cash, about $26 million per year, and more authority to manage its myriad problems.

The measure isn’t perfect. It would give a tremendous amount of power to the unelected Metropolitan Transportation Authority, a semiautonomous agency created in 1999 to reform Muni. But we also understand the arguments of Sup. Aaron Peskin — who wrote the measure in collaboration with labor and other groups — that the MTA is free to make tough decisions that someone facing reelection might avoid. And the measure still would give the Board of Supervisors authority to block the MTA’s budget, fare increases, and route changes with seven votes.

We’re also a little worried about provisions that could place the Taxicab Commission under the MTA’s purview and allow the agency to tinker with the medallion system and undermine Proposition K, the 1978 law that gives operating permits to working drivers, not corporations. Peskin promised us, on tape, that he will ensure, with legislation if necessary, that no such thing happens, and we’ll hold him to it.

Ultimately, the benefits of this measure outweigh our concerns. The fact that the labor movement has signed off on expanded management powers for the MTA shows how important this compromise is. The MTA would have the power to fully implement the impending recommendations in the city’s Transit Improvement Project study and would be held accountable for improvements to Muni’s on-time performance. New bonding authority under the measure would also give the MTA the ability to quickly pursue capital projects that would allow more people to comfortably use public transit.

The measure would also create an integrated transportation system combining everything from parking to cabs to bike lanes under one agency, which would then be mandated to find ways to roll back greenhouse gas emissions from transportation sources to 80 percent of 1990 levels by 2012. And to do that, the agency would get to keep all of the revenue generated by its new programs. As a side benefit — and another important reason to vote for Prop. A — approval of this measure would nullify the disastrous Proposition H on the same ballot.

San Francisco faces lots of tough choices if we’re going to minimize climate change and maximize the free flow of people through our landlocked city. Measure A is an important start. Vote yes.

Proposition B (commission holdovers)

YES


Proposition B is a simple good-government measure that ends a practice then-mayor Willie Brown developed into a science — allowing commissioners to continue serving after their terms expire, turning them into at-will appointments and assuring their loyalty.

Members of some of the most powerful commissions in town serve set four-year terms. The idea is to give the members, many appointed by the mayor, some degree of independence: they can’t be fired summarily for voting against the interests (or demands) of the chief executive.

But once their terms expire, the mayor can simply choose not to reappoint or replace them, leaving them in limbo for months, even years — and while they still sit on the commissions and vote, these holdover commissioners can be fired at any time. So their jobs depend, day by day, on the whims of the mayor.

Prop. B, sponsored by the progressives on the Board of Supervisors, simply would limit to 60 days the amount of time a commissioner can serve as a holdover. After that period, the person’s term would end, and he or she would have to step down. That would force the mayor to either reappoint or replace commissioners in a timely manner — and help give these powerful posts at least a chance at independence. Vote yes.

Proposition C (public hearings on proposed measures)

NO


Proposition C sure sounds good: it would mandate that the supervisors hold a hearing 45 days in advance before putting any measure on the ballot. The mayor would have to submit proposed ballot measures for hearings too. That would end the practice of last-minute legislation; since four supervisors can place any ordinance on the ballot (and the mayor can do the same), proposals that have never been vetted by the public and never subjected to any prior discussion often wind up before the voters. Sometimes that means the measures are poorly written and have unintended consequences.

But this really isn’t a good-government measure; it’s a move by the Chamber of Commerce and downtown to reduce the power of the district-elected supervisors.

The 1932 City Charter gave the supervisors the power to place items before the voters as a check on corruption. In San Francisco it’s been used as a check on downtown power. In 1986, for example, activists gathered enough voter signatures to place Proposition M, a landmark measure controlling downtown development, on the ballot. But then–city attorney Louise Renne, acting on behalf of downtown developers, used a ridiculous technicality to invalidate it. At the last minute, the activists were able to get four supervisors to sign on — and Prop. M, one of the most important pieces of progressive planning legislation in the history of San Francisco, ultimately won voter approval. Under Prop. C, that couldn’t have happened.

In theory, most of the time, anything that goes on the ballot should be subject to public hearings. Sometimes, as in the case of Prop. M, that’s not possible.

We recognize the frustration some groups (particularly small businesses) feel when legislation gets passed without any meaningful input from the people directly affected. But it doesn’t require a strict ballot measure like Prop. C to solve the problem. The supervisors should adopt rules mandating public hearings on propositions, but with a more flexible deadline and exemptions for emergencies. Meanwhile, vote no on Prop. C.

Proposition D (library preservation fund)

YES


In the 1980s and early 1990s, San Francisco mayors loved to cut the budget of the public library. Every time money was short — and money was chronically short — the library took a hit. It was an easy target. If you cut other departments (say, police or fire or Muni or public health), people would howl and say lives were in danger. Reducing the hours at a few neighborhood branch libraries didn’t seem nearly as dire.

So activists who argued that libraries were an essential public service put a measure on the ballot in 1994 that guaranteed at least a modest level of library funding. The improvements have been dramatic: branch library hours have increased more than 50 percent, library use is way up, there are more librarians around in the afternoons to help kids with their homework…. In that sense, the Library Preservation Fund has been a great success. The program is scheduled to sunset next year; Proposition D would extend it another 15 years.

If the current management of the public library system were a bit more trustworthy, this would be a no-brainer. Unfortunately, the library commission and staff have been resisting accountability; ironically, the library — a font of public information — makes it difficult to get basic records about library operations. The library is terrible about sunshine; in fact, activists have had to sue this year to get the library to respond to a simple public-records request (for nonconfidential information on repetitive stress injuries among library staff). And we’re not thrilled that a significant part of the library’s operating budget is raised (and controlled) by a private group, Friends of the San Francisco Public Library, which decides, with no oversight by an elected official, how as much as 10 percent of library money is spent.

But libraries are too valuable and too easy a budget target to allow the Library Preservation Fund to expire. And the way to fend off creeping privatization is hardly by starving a public institution for funds. So we’ll support Prop. D.

Proposition E (mayoral attendance at Board of Supervisors meetings)

YES, YES, YES


If it feels as though you’ve already voted on this, you have: last November, by a strong majority, San Franciscans approved a policy statement calling on the mayor to attend at least one Board of Supervisors meeting each month to answer questions and discuss policy. It’s a great idea, modeled on the very successful Question Time in the United Kingdom, under which the British prime minister appears before Parliament regularly and submits to questions from all political parties. Proposition E would force the mayor to comply. Newsom, despite his constant statements about respecting the will of the voters, has never once complied with the existing policy statement. Instead, he’s set up a series of phony neighborhood meetings at which he controls the agenda and personally selects which questions he’s going to answer.

We recognize that some supervisors would use the occasion of the mayor’s appearance to grandstand — but the mayor does that almost every day. Appearing before the board once a month isn’t an undue burden; in fact, it would probably help Newsom in the long run. If he’s going to seek higher office, he’s going to have to get used to tough questioning and learn to deal with critics in a forum he doesn’t control.

Beyond all the politics, this idea is good for the city. The mayor claims he already meets regularly with members of the board, but those meetings are private, behind closed doors. Hearing the mayor and the board argue about policy in public would be informative and educational and help frame serious policy debates. Besides, as Sup. Chris Daly says, with Newsom a lock for reelection, this is the only thing on the ballot that would help hold him accountable. Vote yes on Prop. E.

Proposition F (police pensions)

YES


We really didn’t want to endorse this measure. We’re sick and tired of the San Francisco Police Officers Association — which opposed violence-prevention funding, opposed foot patrols, opposes every new revenue measure, and bitterly, often viciously, opposes police accountability — coming around, tin cup in hand, every single election and asking progressives to vote to give the cops more money. San Francisco police officers deserve decent pay — it’s a tough, dangerous job — but the starting salary for a rookie cop in this town exceeds $60,000, the benefits are extraordinarily generous, and the San Francisco Police Department is well on its way to setting a record as the highest-paid police force in the country.

Now it wants more.

But in fact, Proposition F is pretty minor — it would affect only about 60 officers who were airport cops before the airport police were merged into the SFPD in 1997. Those cops have a different retirement system, which isn’t quite as good as what they would get with full SFPD benefits. We’re talking about $30,000 a year; in the end, it’s a simple labor issue, and we hate to blame a small group of officers in one division for the serious sins of their union and its leadership. So we’ll endorse Prop. F. But we have a message for the SFPOA’s president: if you want to beat up the progressives, reject new tax plans, promote secrecy, and fight accountability, don’t come down here again asking for big, expensive benefit improvements.

Proposition G (Golden Gate Park stables)

YES


This is an odd one: Proposition G, sponsored by Sup. Jake McGoldrick, would create a special fund for the renovation of the historic (and dilapidated) horse stables in Golden Gate Park. The city would match every $3 in private donations with $1 in public money, up to a total of $750,000. The city would leverage that money with $1.2 million in state funds available for the project and fix up the stables.

Supporters, including most of the progressive supervisors, say that the stables are a historic gem and that horseback riding in the park would provide "after-school, summer and weekend activities for families and youth." That might be a bit of a stretch — keeping horses is expensive, and riding almost certainly won’t be a free activity for anyone. But the stables have been the target of privatization efforts in the past and, under Newsom, almost certainly would be again in the future; this is exactly the sort of operation that the mayor would like to turn over to a private contractor. So for a modest $750,000, Prop. G would keep the stables in public hands. Sounds like a good deal to us. Vote yes.

Proposition H (reguutf8g parking spaces)

NO, NO, NO


It’s hard to overstate just how bad this measure is or to condemn strongly enough the sleazy and deceptive tactics that led Don Fisher, Webcor, and other downtown power brokers to buy the signatures that placed what they call "Parking for the Neighborhoods" on the ballot. That’s why Proposition H has been almost universally condemned, even by downtown’s allies in City Hall, and why Proposition A includes a provision that would negate Proposition H if both are approved.

Basically, this measure would wipe out three decades’ worth of environmentally sound planning policies in favor of giving every developer and homeowner the absolute right to build a parking space for every housing unit (or two spaces for every three units in the downtown core). While that basic idea might have some appeal to drivers with parking frustrations, even they should consider the disastrous implications of this greedy and shortsighted power grab.

The city has very little leverage to force developers to offer community benefits like open space or more affordable housing, or to design buildings that are attractive and environmentally friendly. But parking spots make housing more valuable (and expensive), so developers will help the city meet its needs in order to get them. That would end with this measure, just as the absolute right to parking would eliminate things like Muni stops and street trees while creating more driveways, which are dangerous to bicyclists and pedestrians. It would flip the equation to place developers’ desires over the public interest.

Worst of all, it would reverse the city’s transit-first policies in a way that ultimately would hurt drivers and property owners, the very people it is appealing to. If we don’t limit the number of parking spots that can be built with the 10,000 housing units slated for the downtown core, it will result in traffic gridlock that will lower property values and kill any chance of creating a world-class transit system.

But by then, the developers will be off counting our money, leaving us to clean up their mess. Don’t be fooled. Vote no.

Proposition I (Office of Small Business)

YES


Proposition I got on the ballot after small-business leaders tried unsuccessfully to get the supervisors to fund a modest program to create staff for the Small Business Commission and create a one-stop shop for small-business assistance and permitting. We don’t typically support this sort of after-the-fact ballot-box budgeting request, but we’re making an exception here.

San Francisco demands a lot from small businesses. It’s an expensive place to set up shop, and city taxes discriminate against them. We supported the new rules mandating that even small operations give paid days off and in many cases pay for health insurance, but we recognize that they put a burden on small businesses. And in the end, the little operators don’t get a whole lot back from City Hall.

This is a pretty minor request: it would allocate $750,000 to set up an Office of Small Business under the Small Business Commission. The funding would be for the first year only; after that the advocates would have to convince the supervisors that it was worth continuing. Small businesses are the economic and job-generation engines of San Francisco, and this one-time request for money that amounts to less than 1/10th of 1 percent of the city budget is worthy of support. Vote yes on Prop. I.

Proposition J (wireless Internet network)

NO


It’s going to be hard to convince people to vote against this measure; as one blogger put it, the mayor of San Francisco is offering free ice cream. Anyone want to decline?

Well, yes — decline is exactly what the voters should do. Because Proposition J’s promise of free and universal wireless Internet service is simply a fraud. And the way it’s worded would ensure that our local Internet infrastructure is handed over to a private company — a terrible idea.

For starters, San Francisco has already been down this road. Newsom worked out a deal a year ago with EarthLink and Google to provide free wi-fi. But the contract had all sorts of problems: the free access would have been too slow for a lot of uses, faster access wouldn’t have been free, there weren’t good privacy protections, and the network wouldn’t have been anything close to universal. Wi-fi signals don’t penetrate walls very well, and the signals in this plan wouldn’t have reached much above the second floor of a building — so anyone who lived in an interior space above the second floor (and that’s a lot of people) wouldn’t have gotten access at all.

So the supervisors asked a few questions and slowed things down — and it’s good they did, because EarthLink suddenly had a change in its business strategy and pulled out of citywide wi-fi altogether. That’s one of the problems with using a private partner for this sort of project: the city is subject to the marketing whims of tech companies that are constantly changing their strategies as the economic and technical issues of wi-fi evolve.

San Francisco needs a municipal Internet system; it ought to be part of the city’s public infrastructure, just like the streets, the buses, and the water and sewer lines. It shouldn’t rely just on a fickle technology like wi-fi either; it should be based on fiber-optic cables. Creating that network wouldn’t be all that expensive; EarthLink was going to do it for $10 million.

Prop. J is just a policy statement and would have no immediate impact. Still, it’s annoying and wrongheaded for the mayor to try to get San Franciscans to give a vote of confidence to a project that has already crashed and burned, and Sup. Aaron Peskin, the cosponsor, should never have put his name on it. Vote no.

Proposition K (ads on street furniture)

YES


San Francisco is awash in commercialism. With all of the billboards and ads, the city is starting to feel like a giant NASCAR racer. And a lot of them come from Clear Channel Communications, the giant, monopolistic broadcast outfit that controls radio stations, billboards, and now the contract to build new bus shelters in the city with even more ads on them.

Proposition K is a policy statement, sponsored by Sup. Jake McGoldrick, that seeks to bar any further expansion of street-furniture advertising in the city. That would mean no more deals with the likes of Clear Channel to allow more lighted kiosks with ads on them — and no more new bus shelter ads. That’s got Clear Channel agitated — the company just won the 15-year bid to rebuild the city’s existing 1,200 Muni shelters, and now it wants to add 380 more. Clear Channel argues that the city would get badly needed revenue for Muni from the expanded shelters; actually, the contract already guarantees Muni a large chunk of additional funding. And nothing in Prop. K would block Clear Channel from upgrading the existing shelters and plastering ads all over them.

On a basic philosophical level, we don’t support the idea of funding Muni by selling ads on the street, any more than we would support the idea of funding the Recreation and Park Department by selling the naming rights to the Hall of Flowers or the Japanese Tea Garden or the golf courses. On a practical level, the Clear Channel deal is dubious anyway: the company, which runs 10 mostly lousy radio stations in town and gives almost nothing of value to the community, refuses to provide the public with any information on its projected profits and losses, so there’s no way to tell if the income the city would get from the expanded shelters would be a fair share of the overall revenue.

Vote yes on K.

Imagine this: You’re enrolled in an educational program that requires you to move around from city to city, taking short-term jobs related to your field. Within a span of two years, you bump around between New York, Cleveland, Cincinnati, and San Francisco, subletting rooms and taking on bizarro living arrangements, never staying in one place long enough ever to feel settled in. Due to these circumstances, you rarely have a moment’s peace. Amid all the bustling, your number-one goal remains the same: record an entire album by yourself at home — wherever that may be. And while you’re at it, how about making sure it sounds like a fully realized studio creation?

Impossible, you say? Not so, says Joe Williams, the twentysomething visionary behind the White Williams moniker. The ’70s- and ’80s-flavored one-man band recorded the entirety of the forthcoming debut Smoke — out Nov. 6 on Tigerbeat6 — in exactly those conditions, digitally laying down tracks whenever he had an empty apartment. "Because of the situation, I’d say probably 80 percent of the material was done quite quickly and decisively," Williams explains over the phone from a New York City coffeehouse. "It had to be. The remaining 20 percent was where I had a chance to be more objective, to look at what I’d done."

A heap of credit should be given to that 20 percent. Williams’s aim was to deliver a studio-as-instrument aesthetic — similar to the spirit of David Bowie’s Berlin trilogy and the early Iggy Pop solo albums — and Smoke is a rousing success, especially given the absence of a traditional recording studio. Many of the vocals and guitars have been repitched or drastically edited, and the odd whirs and blips of synths bring to mind a modern take on his heroes’ fertile mid- to late-’70s period. If this sounds like damaged art pop to you, you’re right. "Danger" wobbles with a mind-altering tang of 3 a.m. funk, while "Fleetwood Crack" is the less-troubled cousin to Pop’s "Nightclubbing," opting for similar sparse atmospherics but sparkled with warmer keyboards and the faintest hint of rockabilly guitar. Then there’s my favorite, "In the Club," which answers the question "What would have happened if T.Rex had teamed up with Brian Eno?" Laptop swagger rock, that’s what.

In the end, the limitations of such an itinerant lifestyle proved to be a blessing in disguise. "I discovered that I really enjoy having to solve things entirely by myself … just my mind and the computer," Williams confesses. "And despite the bit-by-bit nature of recording, I’d say it was pretty smooth sailing from start to finish."

Elections usually create an important public discussion on the direction of the city. Unfortunately, that debate isn’t really happening this year, largely because of the essentially uncontested races for sheriff and district attorney and the perception that Mayor Gavin Newsom is certain to be reelected, which has led him to ignore his opponents and the mainstream media to give scant coverage to the mayoral race and the issues being raised.

To the casual observer, it might seem as if everyone is content with the status quo.

But the situation looks quite different from the conference room here at the Guardian, where this season’s endorsement interviews with candidates, elected officials, and other political leaders have revealed a deeply divided city and real frustration with its leadership and direction.

In fact, we were struck by the fact that nobody we talked to had much of anything positive to say about Newsom. Granted, most of the interviews were with his challengers — but we’ve also talked to Sheriff Mike Hennessey and District Attorney Kamala Harris, both of whom have endorsed the mayor, and to supporters and opponents of various ballot measures. And from across the board, we got the sense that Newsom’s popularity in the polls isn’t reflected in the people who work with him on a regular basis.

Newsom will be in to talk to us Oct. 1, and we’ll be running his interview on the Web and allowing him ample opportunity to present his views and his responses.

In the meantime, we offer this look at some of the interesting themes, revelations, and ideas that are emerging from the hours and hours of discussions, because some are quite noteworthy.

Like the fact that mayoral candidates Quintin Mecke and Harold Hoogasian — respectively the most progressive and the most conservative candidate in the race — largely agree on what’s wrong with the Newsom administration, as well as many solutions to the city’s most vexing problems. Does that signal the possibility of new political alliances forming in San Francisco, or at least new opportunities for a wider and more inclusive debate?

Might Lonnie Holmes and Ahimsa Porter Sumchai — two African American candidates with impressive credentials and deep ties to the community — have something to offer a city struggling with high crime rates, lingering racism, environmental and social injustice, and a culture of economic hopelessness? And if we’re a city open to new ideas, how about considering Josh Wolf’s intriguing plan for improving civic engagement, Grasshopper Alec Kaplan’s "green for peace" initiative, or Chicken John Rinaldi’s call to recognize and encourage San Francisco as a city of art and innovation?

There’s a lot going on in the political world that isn’t making the front page of the San Francisco Chronicle. The interviews we’ve been conducting point to a street-level democracy San Francisco–style in all its messy and wonderful glory. And they paint a picture of possibilities that lie beyond the news releases.

THE RIGHT AND THE LEFT


As the owner of Hoogasian Flowers on Seventh Street and a vocal representative of the small-business community, mayoral candidate Hoogasian describes himself as a "sensitive Republican," "a law-and-order guy" who would embrace "zero-based budgeting" if elected. "The best kind of government is the least kind of government," Hoogasian told us.

Those are hardly your typical progressive sentiments.

Yet Hoogasian has also embraced the Guardian‘s call for limiting new construction of market-rate housing until the city develops a plan to encourage the building of more housing affordable to poor and working-class San Franciscans. He supports public power, greater transparency in government, a moratorium on the privatization of government services, and a more muscular environmentalism. And he thinks the mayor is out of touch.

"I’m a native of San Francisco, and I’m pissed off," said Hoogasian, whose father ran for mayor 40 years ago with a similar platform against Joe Alioto. "Newsom is an empty suit. When was the last time the mayor stood before a pool of reporters and held a press conference?"

Mecke, program director of the Safety Network, a citywide public safety program promoting community-driven responses to crime and violence, is equally acerbic when it comes to Newsom’s news-release style of governance.

"It’s great that he wants to focus on the rock star elements, but we have to demand public accountability," said Mecke, who as a member of the Shelter Monitoring Committee helps inspect the city’s homeless shelters to ensure that people are treated with dignity and respect. "Even Willie Brown had some modicum of engagement."

Mecke advocates for progressive solutions to the crime problem. "We need to get the police to change," he said. "At the moment we have 10 fiefdoms, and the often-touted idea of community policing doesn’t exist."

Hoogasian said he jumped into the mayor’s race after "this bozo took away 400 garbage cans and called it an antilitter program." Mecke leaped into the race the day after progressive heavyweight Sup. Chris Daly announced he wasn’t running, and he won the supervisor’s endorsement. Both Hoogasian and Mecke express disgust at Newsom’s ignoring the wishes of San Franciscans, who voted last fall in favor of the mayor attending Board of Supervisors meetings to have monthly policy discussions.

"Why is wi-fi on the ballot [Proposition J] if the mayor didn’t respect that process last year?" Mecke asked.

Hoogasian characterized Newsom’s ill-fated Google-EarthLink deal as "a pie-in-the-sky idea suited to getting young people thinking he’s the guns" while only giving access to "people sitting on the corner of Chestnut with laptops, drinking lattes."

In light of San Francisco’s housing crisis, Hoogasian said he favors a moratorium on market-rate housing until 25,000 affordable units are built, and Mecke supports placing a large affordable-housing bond on next year’s ballot, noting, "We haven’t had one in 10 years."

Hoogasian sees Newsom’s recent demand that all department heads give him their resignations as further proof that the mayor is "chickenshit." Mecke found it "embarrassing" that Sup. Ross Mirkarimi had to legislate police foot patrols twice in 2006, overcoming Newsom vetoes.

"San Francisco should give me a chance to make this city what it deserves to be, " Hoogasian said.

Mecke said, "I’m here to take a risk, take a chance, regardless of what I think the odds are."

ENDING THE VIOLENCE


Holmes and Sumchai have made the murder rate and the city’s treatment of African Americans the centerpieces of their campaigns. Both support increased foot patrols and more community policing, and they agree that the root of the problem is the need for more attention and resources.

"The plan is early intervention," Holmes said, likening violence prevention to health care. "We need to start looking at preventative measures."

In addition to mentoring, after-school programs, and education, Holmes specifically advocates comprehensive community resource centers — a kind of one-stop shopping for citizens in need of social services — "so individuals do not have to travel that far outside their neighborhoods. If we start putting city services out into the communities, then not only are we looking at a cost savings to city government, but we’re also looking at a reduction in crime."

Sumchai, a physician, has studied the cycles of violence that occur as victims become perpetrators and thinks more medical approaches should be applied to social problems. "I would like to see the medical community address violence as a public health problem," she said.

Holmes said he thinks the people who work on violence prevention need to be homegrown. "We also need to talk about bringing individuals to the table who understand what’s really going on in the streets," he said. "The answer is not bringing in some professional or some doctor from Boston or New York because they had some elements of success there.

"When you take a plant that’s not native to the soil and try to plant it, it dies…. If there’s no way for those program elements or various modalities within those programs to take root somewhere, it’s going to fail, and that’s what we’ve seen in the Newsom administration."

Holmes spoke highly of former mayor Art Agnos’s deployment of community workers to walk the streets and mitigate violence by talking to kids and brokering gang truces.

The fate of the southeast sector of the city concerns both locals. Sumchai grew up in Sunnydale, and Holmes lived in the Western Addition and now lives in Bernal Heights. Neither is pleased with the city’s redevelopment plan for the Hunters Point Shipyard. "I have never felt that residential development at the shipyard would be safe," said Sumchai, who favors leaving the most toxic sites as much-needed open space.

Despite some relatively progressive ideas — Holmes suggested a luxury tax to finance housing and services for homeless individuals, and Sumchai would like to see San Francisco tax fatty foods to pay for public health programs — both were somewhat averse to aligning too closely with progressives.

Sumchai doesn’t like the current makeup of the Board of Supervisors, and Holmes favors cutting management in government and turning services over to community-based organizations.

But both made it clear that Newsom isn’t doing much for the African American community.

ORIGINAL IDEAS


The mayor’s race does have several colorful characters, from the oft-arrested Kaplan to nudist activist George Davis to ever-acerbic columnist and gadfly H. Brown. Yet two of the more unconventional candidates are also offering some of the more original and thought-provoking platforms in the race.

Activist-blogger Wolf made a name for himself by refusing to turn over to a federal grand jury his video footage from an anarchist rally at which a police officer was injured, defying a judge’s order and serving 226 days in federal prison, the longest term ever for someone asserting well-established First Amendment rights.

The Guardian and others have criticized the San Francisco Police Department’s conduct in the case and Newsom’s lack of support. But Wolf isn’t running on a police-reform platform so much as a call for "a new democracy plan" based loosely on the Community Congress models of the 1970s, updated using the modern technologies in which Wolf is fluent.

"The basic principle can be applied more effectively today with the advent of the Internet and Web 2.0 than was at all possible to do in the 1970s," Wolf said, calling for more direct democracy and an end to the facade of public comment in today’s system, which he said is "like talking to a wall."

"It’s not a dialogue, it’s not a conversation, and it’s certainly not a conversation with other people in the city," Wolf said. "No matter who’s mayor or who’s on the Board of Supervisors, the solutions that they are able to come up with are never going to be able to match the collective wisdom of the city of San Francisco. So building an online organism that allows people to engage in discussions about every single issue that comes across City Hall, as well as to vote in a sort of straw-poll manner around every single issue and to have conversations where the solutions can rise to the surface, seems to be a good step toward building a true democracy instead of a representative government."

Also calling for greater populism in government is Chicken John Rinaldi (see "Chicken and the Pot," 9/12/07), who shared his unique political strategy with us in a truly entertaining interview.

"I’m here to ask for the Guardian‘s second-place endorsement," Rinaldi said, aware that we intend to make three recommendations in this election, the first mayor’s race to use the ranked-choice voting system.

Asked if his running to illustrate a mechanism is akin to a hamster running on a wheel, Rinaldi elaborated on the twin issues that he holds dear to his heart — art and innovation — by talking about innovative ways to streamline the current complexities that artists, performers, and others must face when trying to get a permit to put on an event in San Francisco.

"I’m running for the idea of San Francisco," Rinaldi said. He claimed to be painting a campaign logo in the style of a mural on the side of his warehouse in the Mission District: "It’s going to say, ‘Chicken, it’s what’s for mayor,’ or ‘Chicken, the other white mayor.’"

He repeatedly said that he doesn’t know what he’s talking about; when we asked him what he’d do if he won, he told us that he’ll hire Mecke, Holmes, Sumchai, and Wolf to run the city.

Yet his comedy has a serious underlying message: "I want to create an arts spark." And that’s something he’s undeniably good at.

THE LAW-ENFORCEMENT VIEW


Sheriff Hennessey and District Attorney Harris aren’t being seriously challenged for reelection, and both decided early (despite pleas from their supporters) not to take on Newsom for the top job. In fact, they’re both endorsing him.

But in interviews with us, they were far from universally laudatory toward the incumbent mayor, saying he needs to do much more to get a handle on crime and the social- and economic-justice issues that drive it.

Hennessey said San Francisco’s county jail system is beyond its capacity for inmates and half of them are behind bars on drug charges, even in a city supposedly opposed to the war on drugs.

"I had this conversation with the mayor probably a year ago," Hennessey said. "I took him down to the jail to show him there were people sleeping on the floor at that time. I needed additional staff to open up a new unit. He came down and looked at the jails and said, ‘Yeah, this is not right.’"

Asked how he would cut the jail population in half, Hennessey — in all seriousness — suggested firing the city’s narcotics officers. He readily acknowledged that the culture within the SFPD is a barrier to creating a real dialogue and partnership with the rest of the city. How would he fix it? Make the police chief an elected office.

"From about 1850 to 1895, the San Francisco police chief was elected," he said. "I think it’d be a very good idea for this city. It’s a small enough city that I think the elected politicians really try to be responsive to the public will."

Hennessey said that with $10 million or $15 million more, he could have an immediate impact on violence in the city by expanding a program he began last year called the No Violence Alliance, which combines into one community-based case-management system all of the types of services that perpetrators of violence are believed to be lacking: stable housing, education, decent jobs, and treatment for drug addiction.

Harris told us so-called quality-of-life crimes, including hand-to-hand drug sales no matter how small, deserve to be taken seriously. But it’s not a crime to be poor or homeless, she insisted and eagerly pointed to her own reentry program for offenders, Back on Track.

More than half of the felons paroled in San Francisco in 2003 returned to prison not long thereafter, reaffirming the continuing plague of recidivism in California. Harris said more than 90 percent of the people who participated in the pilot phase of Back on Track were holding down a job or attending school by the time they graduated from the program. "DAs around the country are listening to what we’re saying about how to achieve smart public safety," she said of the reentry philosophy.

But at the end of the day, Harris is a criminal prosecutor before she’s a nonprofit administrator. And her relationship with the SFPD at times has amounted to little more than a four-year stalemate. Harris and former district attorney Terrence Hallinan both endured accusations by cops that they were too easy on defendants and reluctant to prosecute.

To help us understand who’s right when it comes to the murder rate, Harris shared some telling statistics. She said the rate of police solving homicides in San Francisco is about 30 percent, compared with 60 percent nationwide. And she said she’s gotten convictions in 90 percent of the murder cases she’s filed. Nonetheless, cops consistently blame prosecutors for crimes going unpunished.

"I go to so many community meetings and hear the story," she said. "I cannot tell you how often I hear the story…. It’s a self-defeating thing to say, ‘I’m not going to work because the DA won’t prosecute.’ … If no report is taken, then you’re right: I’m not going to prosecute."

YES AND NO


In addition to the candidates, the Guardian also invites proponents and opponents of the most important ballot measures (which this year include the transportation reform Measure A and its procar rival, Measure H), as well as a range of elected officials and activists, including Sups. Aaron Peskin, Tom Ammiano, Jake McGoldrick, Mirkarimi, and Daly.

Although none of these people are running for office, the interviews have produced heated moments: Guardian editor and publisher Bruce B. Brugmann took Peskin and other supervisors to task for not supporting Proposition I, which would create a small-business support center. That, Brugmann said, would be an important gesture in a progressive city that has asked small businesses to provide health care, sick pay, and other benefits.

Taxi drivers have also raised concerns to us about a provision of Measure A — which Peskin wrote with input from labor and others and which enjoys widespread support, particularly among progressives — that could allow the Board of Supervisors to undermine the 29-year-old system that allows only active drivers to hold valuable city medallions. In response, Peskin told us that was not the intent and that he is already working with Newsom to address those concerns with a joint letter and possible legislation.

"If San Francisco is going to be a world-class city, it’s got to have a great transportation infrastructure," Peskin told us about the motivation behind Measure A. "This would make sure that San Francisco has a transit-first policy forever."

Measure A would place control of almost all aspects of the transportation system under the Metropolitan Transportation Commission and give that panel more money and administrative powers in the process, while letting the Board of Supervisors retain its power to reject the MTA’s budget, fare hikes, or route changes. He also inserted a provision in the measure that would negate approval of Measure H, the downtown-backed measure that would invalidate existing city parking policies.

Ironically, Peskin said his approach would help prevent the gridlock that would result if the city’s power brokers got their wish of being able to build 10,000 housing units downtown without restrictions on automobile use and a revitalization of public transit options. As he said, "I think we are in many ways aiding developers downtown because [current development plans are] predicated on having a New York–style transit system."

Asked about Newsom’s controversial decision to ask for the resignations of senior staff, Peskin was critical but said he had no intention of having the board intervene. McGoldrick was more animated, calling it a "gutless Gavin move," and said, "If you want to fire them, friggin’ fire them." But he said it was consistent with Newsom’s "conflict-averse and criticism-averse" style of governance.

McGoldrick also had lots to say about Newsom’s penchant for trying to privatize essential city services — "We need to say, ‘Folks, look at what’s happening to your public asset’" — and his own sponsorship of Proposition K, which seeks to restrict advertising in public spaces.

"Do we have to submit to the advertisers to get things done?" McGoldrick asked us in discussing Prop. K, which he authored to counter "the crass advertising blight that has spread across this city."*

Sup. Ross Mirkarimi likes to say that murder and Muni are Mayor Gavin Newsom’s most obvious weaknesses, and there are all kinds of ideas about fixing Muni. Murder, that’s a little tougher.

The mayoral candidates we’ve been talking to all decry the city’s rise in violent crime, and they all say something has to be done. The district attorney says so, and so does the Police Officers Association. But there’s a lot of finger-pointing going on, and a lot of rhetoric and circling around and dodging. I realize it’s a tough, complicated issue; I realize that one city can’t utterly transform the socioeconomic impacts of more than a quarter century of federal neglect of inner cities. I know that poverty and desperation drive crime and violence, and what we’re experiencing in San Francisco won’t be solved by any one simple program.

But I have to say, I’ve heard an idea from one of the candidates that just makes a lot of common sense.

Lonnie Holmes, who almost certainly won’t be elected, told us in an endorsement interview that the mentor he relied on when he was a kid growing up in a tough neighborhood in San Francisco was the guy who ran the local recreation center. It was open all the time; Holmes would just drop in after school, hang out, play some basketball…. There was a place to go, with a caring adult who was a supervisor, coach, teacher, and role model. No pressure, no special classes to sign up for, no fee, no cost at the door. Just a local rec center. There are dozens of them, all over the city.

But these days a lot of them aren’t open as much. Budget cuts to the Recreation and Park Department have forced the rec centers to limit their hours. The center in Bernal Heights, where I live, used to be open on weekends; now the doors are mostly locked.

There’s not a lot in the way of quality public after-school programs either.

So kids who don’t have a stable home life, or whose parents or guardians are working two jobs and are rarely around, or who have any of a long list of factors that put them at risk for violence don’t have anywhere to go. Bad idea.

So why not a budget plan to fully fund all the rec centers and fund comprehensive after-school care as a means of violence prevention? It’s a lot cheaper than hiring a few hundred more cops.

Onward: there’s a fascinating comment at the very end of the seven-page city attorney’s opinion on Newsom’s call for mass resignations by department heads and other top city officials. It’s just two sentences, and the relevant part goes like this: "The resignations … may present other legal issues…. For example, there could be questions about whether to make public disclosures under certain city bonds or municipal debt issuances."

Here’s what that means: the city could be required to tell bond holders and underwriters that all of the department heads, the entire senior staff of the Mayor’s Office, and all commissioners — the combined pool of talent and experience at City Hall — have been asked to resign. If anything on this scale happened in a private business, the company’s stock would fall precipitously; one might assume that bond-rating agencies could consider San Francisco to be facing real leadership troubles and reduce our bond rating.

That, in turn, would cost the city a sizable amount of money.

My only problem with the survey is that it doesn’t ask about police abuse or accountability, but it does ask about effectiveness, and there are places where you can type in comments.

Our three-point plan to save San Francisco

Curtis Aaron leaves his house at 9 a.m. and drives to work as a recreation center director for the San Francisco Recreation and Park Department. He tries to leave enough time for the trip; he’s expected on the job at noon.

Aaron lives in Stockton. He moved there with his wife and two kids three years ago because “there was no way I could buy a place in San Francisco, not even close.” His commute takes three hours one way when traffic is bad. He drives by himself in a Honda Accord and spends $400 a month on gas.

Peter works for the city as a programmer and lives in Suisun City, where he moved to buy a house and start a family. Born and raised in San Francisco, he is now single again, with grown-up children and a commute that takes a little more than an hour on a good day.

“I’d love to move back. I love city life, but I want to be a homeowner, and I can’t afford that in the city,” Peter, who asked us not to use his last name, explained. “I work two blocks from where I grew up and my mom’s place, which she sold 20 years ago. Her house is nothing fancy, but it’s going for $1.2 million. There’s no way in hell I could buy that.”

Aaron and Peter aren’t paupers; they have good, unionized city jobs. They’re people who by any normal standard would be considered middle-class — except that they simply can’t afford to live in the city where they work. So they drive long distances every day, burning fossil fuels and wasting thousands of productive hours each year.

Their stories are hardly unique or new; they represent part of the core of the city’s most pressing problem: a lack of affordable housing.

Just about everyone on all sides of the political debate agrees that people like Aaron and Peter ought to be able to live in San Francisco. Keeping people who work here close to their jobs is good for the environment, good for the community, and good for the workers.

“A lack of affordable housing is one of the city’s greatest challenges,” Mayor Gavin Newsom acknowledged in his 2007–08 draft budget.

The mayor’s answer — which at times has the support of environmentalists — is in part to allow private developers to build dense, high-rise condominiums, sold at whatever price the market will bear, with a small percentage set aside for people who are slightly less well-off.

The idea is that downtown housing will appeal to people who work in town, keeping them out of their cars and fighting sprawl. And it assumes that if enough market-rate housing is built, eventually the price will come down. In the meantime, demanding that developers make somewhere around 15 percent of their units available at below-market rates should help people like Aaron and Peter — as well as the people who make far less money, who can never buy even a moderately priced unit, and who are being displaced from this city at an alarming rate. And a modest amount of public money, combined with existing state and federal funding, will make affordable housing available to people at all income levels.

But the facts are clear: this strategy isn’t working — and it never will. If San Francisco has any hope of remaining a city with economic diversity, a city that has artists and writers and families and blue-collar workers and young people and students and so many of those who have made this one of the world’s great cities, we need to completely change how we approach the housing issue.

 

HOMELESS OR $100,000

The housing plans coming out of the Mayor’s Office right now are aimed primarily at two populations: the homeless people who have lost all of their discretionary income due to Newsom’s Care Not Cash initiative, and people earning in the neighborhood of $100,000 a year who can’t afford to buy homes. For some time now, the mayor has been diverting affordable-housing money to cover the unfunded costs of making Care Not Cash functional; at least that money is going to the truly needy.

Now Newsom’s housing director, Matt Franklin, is talking about what he recently told the Planning Commission is a “gaping hole” in the city’s housing market: condominiums that would allow people on the higher end of middle income to become homeowners.

At a hearing Sept. 17, Doug Shoemaker of the Mayor’s Office of Housing told a Board of Supervisors committee that the mayor wants to see more condos in the $400,000 to $600,000 range — which, according to figures presented by Service Employees International Union Local 1021, would be out of the reach of, say, a bus driver, a teacher, or a licensed vocational nurse.

Newsom has put $43 million in affordable-housing money into subsidies for new home buyers in the past year. The Planning Department is looking at the eastern neighborhoods as ground zero for a huge new boom in condos for people who, in government parlance, make between 120 and 150 percent of the region’s median income (which is about $90,000 a year for a family of four).

In total, the eastern neighborhoods proposal would allow about 7,500 to 10,000 new housing units to be added over the next 20 years. Downtown residential development at Rincon Hill and the Transbay Terminal is expected to add 10,000 units to the housing mix, and several thousand more units are planned for Visitacion Valley.

The way (somewhat) affordable housing will be built in the eastern part of town, the theory goes, is by creating incentives to get developers to build lower-cost housing. That means, for example, allowing increases in density — changing zoning codes to let buildings go higher, for example, or eliminating parking requirements to allow more units to be crammed into an available lot. The more units a developer can build on a piece of land, the theory goes, the cheaper those units can be.

But there’s absolutely no empirical evidence that this has ever worked or will ever work, and here’s why: the San Francisco housing market is unlike any other market for anything, anywhere. Demand is essentially insatiable, so there’s no competitive pressure to hold prices down.

“There’s this naive notion that if you reduce costs to the market-rate developers, you’ll reduce the costs of the unit,” Calvin Welch, an affordable-housing activist with more than three decades of experience in housing politics, told the Guardian. “But where has that ever happened?”

In other words, there’s nothing to keep those new condos at rates that even unionized city employees — much less service-industry workers, nonprofit employees, and those living on much lower incomes — can afford.

In the meantime, there’s very little discussion of the impact of increasing density in the nation’s second-densest city. Building housing for tens of thousands of new people means spending hundreds of millions of dollars on parks, recreation centers, schools, police stations, fire stations, and Muni lines for the new neighborhoods — and that’s not even on the Planning Department’s radar. Who’s going to pay for all that? Nothing — nothing — in what the mayor and the planners are discussing in development fees will come close to generating the kind of cash it will take to make the newly dense areas livable.

“The solution we are striving for has not been achieved,” said Chris Durazo, chair of the South of Market Community Action Network, an organizing group. “Should we be looking at the cost to developers to build affordable housing or the cost to the neighborhood to be healthy? We’re looking at the cumulative impacts of policy, ballot measures, and planning and saying it doesn’t add up.”

In fact, Shoemaker testified before the supervisors’ committee that the city is $1.14 billion short of the cash it needs to build the level of affordable housing and community amenities in the eastern neighborhoods that are necessary to meet the city’s own goals.

This is, to put it mildly, a gigantic problem.

 

THE REST OF US

Very little of what is on the mayor’s drawing board is rental housing — and even less is housing available for people whose incomes are well below the regional median, people who earn less than $60,000 a year. That’s a large percentage of San Franciscans.

The situation is dire. Last year the Mayor’s Office of Community Development reported that 16 percent of renters spend more than half of their income on housing costs. And a recent report from the National Low Income Housing Coalition notes that a minimum-wage earner would have to work 120 hours a week, 52 weeks a year, to afford the $1,551 rent on a two-bedroom apartment if they spent the recommended 30 percent of their income on housing.

Ted Gullickson of the San Francisco Tenants Union told us that Ellis Act evictions have decreased in the wake of 2006 Board of Supervisors legislation that bars landlords from converting their property from rentals to condos if they evict senior or disabled tenants.

But the condo market is so profitable that landlords are now offering to buy out their tenants — and are taking affordable, rent-controlled housing off the market at the rate of a couple of hundred units a month.

City studies also confirm that white San Franciscans earn more than twice as much as their Latino and African American counterparts. So it’s hardly surprising that the Bayview–Hunters Point African American community is worried that it will be displaced by the city’s massive redevelopment plan for that area. These fears were reinforced last year, when Lennar Corp., which is developing 1,500 new units at Hunters Point Shipyard, announced it will only build for-sale condos at the site rather than promised rental units. Very few African American residents of Bayview–Hunters Point will ever be able to buy those condos.

Tony Kelly of the Potrero Hill Boosters believes the industrial-zoned land in that area is the city’s last chance to address its affordable-housing crisis. “It’s the biggest single rezoning that the city has ever tried to do. It’s a really huge thing. But it’s also where a lot of development pressure is being put on the city, because the first sale on this land, once it’s rezoned, will be the most profitable.”

Land use attorney Sue Hestor sees the eastern neighborhoods as a test of San Francisco’s real political soul.

“There is no way it can meet housing goals unless a large chunk of land goes for affordable housing, or we’ll export all of our low-income workers,” Hestor said. “We’re not talking about people on welfare, but hotel workers, the tourist industry, even newspaper reporters.

“Is it environmentally sound to export all your workforce so that they face commute patterns that take up to three and four hours a day, then turn around and sell condos to people who commute to San Jose and Santa Clara?”

 

A THREE-POINT PLAN

It’s time to rethink — completely rethink — the way San Francisco addresses the housing crisis. That involves challenging some basic assumptions that have driven housing policy for years — and in some quarters of town, it’s starting to happen.

There are three elements of a new housing strategy emerging, not all from the same people or organizations. It’s still a bit amorphous, but in community meetings, public hearings, blog postings, and private discussions, a program is starting to take shape that might actually alter the political landscape and make it possible for people who aren’t millionaires to rent apartments and even buy homes in this town.

Some of these ideas are ours; most of them come from community leaders. We’ll do our best to give credit where it’s due, but there are dozens of activists who have been participating in these discussions, and what follows is an amalgam, a three-point plan for a new housing policy in San Francisco.

1. Preserve what we have. This is nothing new or terribly radical, but it’s a cornerstone of any effective policy. As Welch points out repeatedly, in a housing crisis the cheapest and most valuable affordable housing is the stuff that already exists.

Every time a landlord or real estate speculator tries to make a fast buck by evicting a tenant from a rent-controlled apartment and turning that apartment into a tenancy in common or a condo, the city’s affordable-housing stock diminishes. And it’s far cheaper to look for ways to prevent that eviction and that conversion than it is to build a new affordable-rental apartment to replace the one the city has lost.

The Tenants Union has been talking about this for years. Quintin Mecke, a community organizer who is running for mayor, is making it a key part of his platform: More city-funded eviction defense. More restrictions on what landlords can do with buildings emptied under the Ellis Act. And ultimately, a statewide strategy to get that law — which allows landlords to clear a building of tenants, then sell it as condos — repealed.

Preserving existing housing also means fighting the kind of displacement that happens when high-end condos are squeezed into low-income neighborhoods (which is happening more and more in the Mission, for example, with the recent approval of a market-rate project at 3400 César Chávez).

And — equally important — it means preserving land.

Part of the battle over the eastern neighborhoods is a struggle for limited parcels of undeveloped or underdeveloped real estate. The market-rate developers have their eyes (and in many cases, their claws) on dozens of sites — and every time one of them is turned over for million-dollar condos, it’s lost as a possible place to construct affordable housing (or to preserve blue-collar jobs).

“Areas that have been bombarded by condos are already lost — their industrial buildings and land are already gone,” Oscar Grande of People Organizing to Demand Environmental and Economic Rights told us.

So when activists (and some members of the Board of Supervisors) talk about slowing down or even stopping the construction of new market-rate housing in the eastern neighborhoods area, it’s not just about preventing the displacement of industry and blue-collar jobs; it’s also about saving existing, very limited, and very valuable space for future affordable housing.

And that means putting much of the eastern neighborhoods land off limits to market-rate housing of any kind.

The city can’t exactly use zoning laws to mandate low rents and low housing prices. But it can place such high demands on developers — for example, a requirement that any new market-rate housing include 50 percent very-low-income affordable units — that the builders of the million-dollar condos will walk away and leave the land for the kind of housing the city actually needs.

2. Find a new, reliable, consistent way to fund affordable housing. Just about everyone, including Newsom, supports the notion of inclusionary housing — that is, requiring developers to make a certain number of units available at lower-than-market rates. In San Francisco right now, that typically runs at around 15 percent, depending on the size of the project; some activists have argued that the number ought to go higher, up to 20 or even 25 percent.

But while inclusionary housing laws are a good thing as far as they go, there’s a fundamental flaw in the theory: if San Francisco is funding affordable housing by taking a small cut of what market-rate developers are building, the end result will be a city where the very rich far outnumber everyone else. Remember, if 15 percent of the units in a new luxury condo tower are going at something resembling an affordable rate, that means 85 percent aren’t — and ultimately, that leads to a population that’s 85 percent millionaire.

The other problem is how you measure and define affordable. That’s typically based on a percentage of the area’s median income — and since San Francisco is lumped in with San Mateo and Marin counties for income statistics, the median is pretty high. For a family of four in San Francisco today, city planning figures show, the median income is close to $90,000 a year.

And since many of these below-market-rate projects are priced to be affordable to people making 80 to 100 percent of the median income, the typical city employee or service-industry worker is left out.

In fact, much of the below-market-rate housing built as part of these projects isn’t exactly affordable to the San Franciscans most desperately in need of housing. Of 1,088 below-market-rate units built in the past few years in the city, Planning Department figures show, just 169 were available to people whose incomes were below half of the median (that is, below $45,000 a year for a family of four or $30,000 a year for a single person).

“A unit can be below market rate and still not affordable to 99 percent of San Franciscans,” Welch noted.

This approach clearly isn’t working.

So activists have been meeting during the past few months to hammer out a different approach, a way to sever affordable-housing funding from the construction of market-rate housing — and to ensure that there’s enough money in the pot to make an actual difference.

It’s a big number. “If we have a billion dollars for affordable housing over the next 15 years, we have a fighting chance,” Sup. Chris Daly told us. “But that’s the kind of money we have to talk about to make any real impact.”

In theory, the mayor and the supervisors can just allocate money from the General Fund for housing — but under Newsom, it’s not happening. In fact, the mayor cut $30 million of affordable-housing money this year.

The centerpiece of what Daly, cosponsoring Sup. Tom Ammiano, and the housing activists are talking about is a charter amendment that would earmark a portion of the city’s annual property-tax collections — somewhere around $30 million — for affordable housing. Most of that would go for what’s known as low- and very-low-income housing — units affordable to people who earn less than half of the median income. The measure would also require that current housing expenditures not be cut — to “lock in everything we’re doing now,” as Daly put it — so that that city would have a baseline of perhaps $60 million a year.

Since the federal government makes matching funds available for many affordable-housing projects, that money could be leveraged into more than $1 billion.

Of course, setting aside $30 million for affordable housing means less money for other city programs, so activists are also looking at ways to pay for it. One obvious option is to rewrite the city’s business-tax laws, replacing some or all of the current payroll tax money with a tax on gross receipts. That tax would exempt all companies with less than $2 million a year in revenue — the vast majority of the small businesses in town — and would be skewed to tax the bigger businesses at a higher rate.

Daly’s measure is likely headed for the November 2008 ballot.

The other funding option that’s being discussed in some circles — including the Mayor’s Office of Housing — is complicated but makes a tremendous amount of sense. Redevelopment agencies now have the legal right to sell revenue bonds and to collect income based on so-called tax increments — that is, the increased property-tax collections that come from a newly developed area. With a modest change in state law, the city should be able to do that too — to in effect capture the increased property taxes from new development in, say, the Mission and use that money entirely to build affordable housing in the neighborhood.

That, again, is a big pot of cash — potentially tens of millions of dollars a year. Assemblymember Mark Leno (D–San Francisco) told us he’s been researching the issue and is prepared to author state legislation if necessary to give the city the right to use tax-increment financing anywhere in town. “With a steady revenue stream, you can issue revenue bonds and get housing money up front,” he said.

That’s something redevelopment agencies can do, and it’s a powerful tool: revenue bonds don’t have to go to the voters and are an easy way to raise money for big projects — like an ambitious affordable-housing development program.

Somewhere, between all of these different approaches, the city needs to find a regular, steady source for a large sum of money to build housing for people who currently work in San Francisco. If we want a healthy, diverse, functioning city, it’s not a choice any more; it’s a mandate.

3. A Proposition M for housing. One of the most interesting and far-reaching ideas we’ve heard in the past year comes from Marc Salomon, a Green Party activist and policy wonk who has done extensive research into the local housing market. It may be the key to the city’s future.

In March, Salomon did something that the Planning Department should have done years ago: he took a list of all of the housing developments that had opened in the South of Market area in the past 10 years and compared it to the Department of Elections’ master voter files for 2002 and 2006. His conclusion: fully two-thirds of the people moving into the new housing were from out of town. The numbers, he said, “indicate that the city is pursuing the exact opposite priorities and policies of what the Housing Element of the General Plan calls for in planning for new residential construction.”

That confirms what we found more than a year earlier when we knocked on doors and interviewed residents of the new condo complexes (“A Streetcar Named Displacement,” 10/19/05). The people for whom San Francisco is building housing are overwhelmingly young, rich, white commuters who work in Silicon Valley. Or they’re older, rich empty nesters who are moving back to the city from the suburbs. They aren’t people who work in San Francisco, and they certainly aren’t representative of the diversity of the city’s population and workforce.

Welch calls it “socially psychotic” planning.

Twenty-five years ago, the city was doing equally psychotic planning for commercial development, allowing the construction of millions of square feet of high-rise office space that was overburdening city services, costing taxpayers a fortune, creating congestion, driving up residential rents, and turning downtown streets into dark corridors. Progressives put a measure on the November 1986 ballot — Proposition M — that turned the high-rise boom on its head: from then on, developers had to prove that their buildings would meet a real need in the city. It also set a strict cap on new development and forced project sponsors to compete in a “beauty contest” — and only the projects that offered something worthwhile to San Francisco could be approved.

That, Salomon argues, is exactly how the city needs to approach housing in 2007.

He’s been circuutf8g a proposal that would set clear priority policies for new housing. It starts with a finding that is entirely consistent with economic reality: “Housing prices [in San Francisco] cannot be lowered by expanding the supply of market-rate housing.”

It continues, “San Francisco values must guide housing policy. The vast majority of housing produced must be affordable to the vast majority of current residents. New housing must be economically compatible with the neighborhood. The most needy — homeless, very low income people, disabled people, people with AIDS, seniors, and families — must be prioritized in housing production. … [and] market-rate housing can be produced only as the required number of affordable units are produced.”

The proposal would limit the height of all new housing to about six stories and would “encourage limited-equity, permanently affordable homeownership opportunities.”

Salomon suggests that San Francisco limit the amount of new market-rate housing to 250,000 square feet a year — probably about 200 to 400 units — and that the developers “must produce aggressive, competitive community benefit packages that must be used by the Planning Commission as a beauty contest, with mandatory approval by the Board of Supervisors.” (You can read his entire proposal at www.sfbg.com/newpropm.doc.)

There are all kinds of details that need to be worked out, but at base this is a brilliant idea; it could be combined with the new financing plans to shift the production of housing away from the very rich and toward a mix that will preserve San Francisco as a city of artists, writers, working-class people, creative thinkers, and refugees from narrow-minded communities all over, people who want to live and work and make friends and make art and raise families and be part of a community that has always been one of a kind, a rare place in the world.

There is still a way to save San Francisco — but we’re running out of time. And we can’t afford to pursue moderate, incremental plans. A Prop. M for housing

EDITORIAL Big buildings are all the rage in San Francisco these days, and even the environmentalists often go along.

As many as 23 new complexes of 250 units or more, soaring from five or six stories to more than 1,000 feet, are on the drawing board, working their way through the city planning system, and more are almost certainly on their way. And yet there’s very little of the sort of outcry that we saw in the 1980s, when skyscrapers were turning downtown San Francisco into a wall of glass and steel cut by deep, dark, crowded canyons of streets.

This time around the high-rises aren’t, for the most part, office buildings. They’re condominiums — housing. And if you ask many of the major urban environmental groups, what you’ll hear is that density — more housing packed into existing urban areas — is good. Density fights sprawl. Housing near workplaces encourages walking and biking. Housing along transit corridors encourages people to get out of their cars. Urban density is the future: tightly packed cities full of people who don’t commute in private cars are our only hope to fight sprawl, congestion, and global warming. It’s called the new urbanism, and in San Francisco it goes like this: the only way to handle the influx of jobs and population growth is to build another 60,000 or so housing units, on every bit of available land.

But there’s a fundamental flaw in that argument.

Leave aside for the moment the fact that San Francisco is already the second-densest city in the United States. Leave aside the fact that density will come back to haunt us unless San Francisco is capable of creating real neighborhoods, with parks and open spaces, schools, new bus lines, police stations, and all of the other public goods that provide safety and quality of life — and that there’s nothing in any current planning document that shows how the massive, massive price tag for that sort of infrastructure will ever be paid. In a state where property taxes are strictly limited and civic infrastructure is already way overwhelmed and drastically underfunded, it would take extraordinary development fees on every new housing unit just to catch up, much less move ahead.

But let’s just suppose we could eliminate that problem. Would this sort of density be a good thing? No — not if the housing that gets built is mostly sold at prices set by the open market.

The density argument has to go beyond environmental theory and planning policy — because the issue in San Francisco isn’t how tall the buildings are or whether they’re along transit corridors. It’s about who gets to live there. And programs that offer some so-called inclusionary units, which mandate that 15 percent of the new housing be a little cheaper than the rest, aren’t going to cut it.

The facts are clear: the new housing that’s been built in San Francisco over the past 10 years — the downtown-centered, environmentally sound, dense housing — hasn’t helped eliminate commutes or fight global warming. The exact opposite has been happening: the people moving into these expensive, mostly small (and therefore non-family-friendly) units are world travelers who want a perch in San Francisco, retired empty nesters who aren’t going to work anyway, or reverse commuters who work in the tech industry in Silicon Valley. In many cases these new condos are creating more car trips: people who work out of town are buying them — and people who work in San Francisco are so badly priced out of the market that they’re moving farther and farther away.

We showed this two years ago when we went door-to-door in the new buildings to see who lived there and where they worked. Marc Salomon, a green policy wonk, has done a persuasive study using voter registration data that comes to a similar conclusion (see "Our Three-Point Plan to Save San Francisco," page 16). People who work in this city have to leave town to find housing they can afford; a lot of people who are moving into new housing here don’t work in town. It’s environmental psychosis.

There’s only one way to change that — the environmentalists and the housing activists and the progressive policy makers have to acknowledge an incontrovertible fact: sound environmental policy in an urban setting like San Francisco has to start with sound social and economic policy, and in San Francisco that means abandoning developer-driven housing and starting over. It means testing all new projects not on the basis of how close they are to jobs or bus lines or how many cars they will allow underneath or what their density is, but on the basis of how much the housing will cost and who will be able to rent or buy it.

And by those standards, none of the new high-rise buildings in the planning pipeline is even close to a good idea.

In this week’s cover story we describe an alternative approach to housing policy. It’s a three-part program, and the first two elements — preserving existing rental housing and finding a new funding mechanism for affordable-housing construction — are either already on the progressive agenda or rapidly moving forward. The third element is something new — but it deserves serious discussion.

It’s the idea, first put forward by Salomon, of adopting a comprehensive, citywide housing policy that would resemble the 1986 ballot measure known as Proposition M. Prop. M was designed to limit the impact of runaway commercial office development, and it set specific priority policies for all new projects, including the preservation of neighborhood character. It also strictly limited the amount of new office space that could be built in any one year and mandated that developers compete for the right to build. The projects that best suited the city’s needs (not the developers’ needs) would get the go-ahead; the others wouldn’t make the cut.

Imagine how that would work for housing. Say the voters passed a measure that limited new for-profit, market-rate housing to 500 units per year. The developers who wanted to win that lottery would have to come to the table with good offers — plenty of affordable set-asides, green buildings, structures that weren’t out of synch with the area, money for parks, schools, and other neighborhood services…. What could possibly be wrong with that?

San Francisco needs a cap on new housing for the rich and a mandate that all housing meet community needs. A well-crafted Prop. M–<\d>style ballot measure might energize the neighborhoods, force elected officials to talk seriously about housing … and save San Francisco. That ought to be on everyone’s agenda.*

Letters as leverage

It’s a thin, seemingly innocuous letter. The Social Security Administration mails it when names and Social Security numbers don’t match on an employee’s I-9 form. The intent is to make sure workers receive their benefits.

But unions and immigrants have long charged that unscrupulous employers use SSA "no match" letters to harass undocumented workers and squelch union organizing efforts. Now, after a failed immigration debate in Congress, the George W. Bush administration wants to pass a regulation that would explicitly turn the letter into an immigration enforcement tool.

Activists fear this could result in massive firings and retaliation against workers organizing with unions. Employers complain it could lead to an economic slump in industries dependent on undocumented labor. A temporary injunction granted by a San Francisco judge is the only thing holding back letters across the country; it ends Oct. 1.

Bay Area activists have been national leaders at the intersection of immigrant rights and labor movements. They are now shaping national policy on this new regulation in the courts and promise wide-scale street action and workplace walkouts if it goes into effect.

A look at past and present related Bay Area organizing may shed light on the future of the national issue.

US companies file hundreds of millions of W-2 forms with the SSA every year. The SSA uses them to calculate how much it owes workers at retirement. When the name and the Social Security number do not match, the SSA sends a "no match" letter to the employee to clear up the discrepancy. The letters are also sent to employers who have more than 10 employees with no match. These letters have nothing to do with immigration law, and employers are not required to take any adverse action against these employees.

But under the new Department of Homeland Security regulation, no-match letters may be seen as evidence that an employer knowingly employed an undocumented worker. The letters would include a leaflet from US Immigration and Customs Enforcement informing employers that they must fire workers who cannot resolve no matches with the SSA or reverify their work authorization within 93 days. If the companies do not, they may be subject to fines or criminal charges.

The rule was drafted more than a year ago but was not announced by Homeland Security secretary Michael Chertoff until Aug 10. "The magnet that brings most economic migrants into this country is work," he explained. "And if we have worksite enforcement directed at illegal employment, we strike at that magnet."

Brooke Anderson, an organizer with the East Bay Alliance for a Sustainable Economy, told the Guardian that this is an unlikely scenario. Workers will not leave the country; they will simply be forced into underground economies, rotate through different jobs, and become even more vulnerable.

Anderson was among a delegation of more than 30 labor, faith, and community leaders that presented a letter Aug. 30 at the regional SSA office in Richmond. The letter outlined their concerns and asked that the SSA send out no-match letters only to employees, not employers.

"DHS is using an incomplete, hodgepodge system intended to ensure our economic security to implement a regressive immigration policy that Bush failed to pass in Congress," Anderson told us. "The SSA as an agency should have a spine and say no to DHS and no to the Bush administration."

If the ICE inserts do go out with no-match letters, she predicts walkouts and massive street actions.

The regulation is also being challenged in a lawsuit filed by the Central Labor Council of Alameda County. The AFL-CIO, the American Civil Liberties Union, and the San Francisco Central Labor Council have joined it. The plaintiffs claim that because the SSA’s database is full of errors, many citizens and legal immigrants could end up losing their jobs. They also argue that the DHS has exceeded its authority by seeking to use the SSA to enforce immigration laws.

US District Judge Maxine Chesney in San Francisco granted a nationwide temporary restraining order Aug. 31, blocking the SSA from sending letters with ICE inserts. The order is in effect until Oct. 1, when another federal judge here, Charles Breyer, will decide whether to grant another injunction.

"DHS is trying to create a huge terror, to give the illusion that they are doing something," Bill Sokol, a lawyer with Weinberg, Roger, and Rosenfeld, the firm representing the Central Labor Council of Alameda County, told us. "Workers are afraid, but we must dial down people’s fear and terror under our new gestapo."

He said the law will have little impact if employers understand it and do not abuse it. If employers overreact, however, the result could be disastrous. Sokol said employers are already firing employees immediately after receiving the letters.

Unions and immigrant workers across the country have charged that no-match letters have been used to stifle workers’ rights since the SSA began sending them to employers in 1994. Activists in the Bay Area have played a key role in resisting these efforts, setting national precedents upholding worker rights.

When a San Francisco Travelodge fired workers after they began organizing with a union in 1999, allegedly due to Social Security no matches, the terminated employees took it to court. The next year they won an arbitrator’s decision that the firing, based solely on no-match letters, was a violation of their union contract.

Local community pressure on the SSA also resulted in the inclusion of cautionary text in the letter. The no-match letter now states that employers "should not use this letter to take any adverse action against an employee…. Doing so could, in fact, violate state or federal law and subject you to legal consequences."

Activists at Oakland’s Labor Immigrant Organizers Network wrote a resolution in 1999 asking the AFL-CIO to renounce its support of the employer-sanctions provisions of the 1986 Immigration Reform and Control Act, the federal law that for the first time made it illegal for an undocumented worker to hold a job. Their agitation is credited in part for a resolution the AFL-CIO passed in 2000 calling for the repeal of sanctions and for a legalization program for undocumented workers.

The letters remained a potent tool for antiunion activity. A 2003 survey by the Center for Urban Economic Development at the University of Illinois at Chicago found that 25 percent of workers listed in no-match letters reported that their employers fired them in retaliation for complaining about inadequate worksite conditions. More than one in five workers reported that their employer fired them in retaliation for union activity.

San Francisco opposed the DHS no-match regulation when it was proposed last year. An August 2006 resolution by the Board of Supervisors said it may lead to employers "using it as a device to fire, intimidate, harass, or underpay employees." It promised that the city would defy the regulation if it received a no-match letter for a city employee.

The San Francisco Chamber of Commerce and the US Chamber of Commerce also came out against the regulation.

But some employers embraced the proposed regulation. Uniform manufacturer Cintas fired hundreds of employees across the country, allegedly responding to the proposed guidelines after receiving no-match letters during a union organizing drive. Organizers said the company targeted employees involved in the union and jumped the gun on new regulations.

The Woodfin Suite Hotel in Emeryville fired 21 housekeepers in December 2006, also allegedly due to no-match letters. The workers claim the Woodfin retaliated against them for organizing with the East Bay Alliance for a Sustainable Economy, a labor-affiliated think tank, to enforce the living-wage law (see "Calling in the Feds," 6/13/07).

A yearlong campaign targeting the Woodfin has brought the issue to a national audience.

FALSE INFORMATION


Organizers say the regulations are far less strict than the news media has portrayed them, adding to an atmosphere of hysteria and fear among employers and workers. Francisco Ugarte, a lawyer with the Oakland firm of Leonard Carder, held up several San Francisco Chronicle articles at a Sept. 13 workshop for union organizers as examples of media inaccuracies.

An employer is not required to fire an employee after 90 days, as news accounts have stated. The employer has 90 days to fix discrepancies, and the worker has three days after that to fill out another I-9 form with a new Social Security number. If it appears credible, employers must accept the new I-9, Ugarte said.

The ICE insert in the SSA letter will terrify employers, he predicted, but the rule does not create any new information sharing between the SSA and other governmental agencies. The SSA is actually prohibited by law from sharing private data with any other governmental agencies.

There are also no automatic fines assessed to employers, as news accounts have implied. ICE will only levy fines if it raids employers and finds that they did not address no-match discrepancies. It is unlikely that the DHS will be able to enforce the regulations; in announcing them, Chertoff said the agency would rely largely on self-policing.

Even if this is the case, organizers fear that the DHS’s no-match regulation will provide employers with another tool to squelch immigrant workers’ rights. Comprehensive immigration reform is still needed to reconcile employers’ demands for workers, immigrants’ needs for employment, and US immigration policy.*

Slow down the land rush

EDITORIAL At around 11:30 p.m. on the evening of Aug. 30, the San Francisco Planning Commission, its members bleary-eyed and half asleep, approved an eight-unit housing development at 736 Valencia St., despite the anguished pleas of the neighbors. The project includes no affordable housing and is legally designated as condominiums, which means it doesn’t fit the stated goals of the eastern neighborhoods’ planning process, which is supposed to promote affordable housing.

But that planning process is still under way, the proposals so far are weak, and, in the meantime, every developer in town is trying to sneak under the wire and get a project approved before the new rules take effect. And the Planning Commission is allowing that to happen. The supervisors need to intervene now, before it’s too late.

The blueprint for zoning in the city’s eastern neighborhoods — some 2,200 acres that include the central waterfront, Potrero Hill, the Mission, Showplace Square and East SoMa — is critical to the city’s future. Those areas include many of the last industrial sites and blue-collar jobs in the city — and developers are eyeing the land for a massive influx of high-end housing.

If there are going to be decent-paying jobs that don’t require advanced academic degrees in San Francisco, and affordable housing for low-income and working-class people, it will require careful use of this land.

And so far, the signs aren’t good.

The project at 736 Valencia is a perfect example. The commissioners failed to account for the fact that this relatively small project is part of a much larger land grab in the neighborhood; at least six other projects are in the pipeline for a small stretch of that street, and together they’ll have a significant impact on the area. The last thing the Mission — desperate for family and affordable housing — needs is a long strip of new million-dollar condos, built with little in the way of community amenities and little regard for the needs of residents. And yet the commissioners have made it very clear that they aren’t going to slow anything down.

In effect, that means the entire eastern neighborhoods plan — and the hope for a significant increase in affordable housing in town — could be almost pointless. By the time the plan is in place — early next year at the earliest, and that may be an optimistic timeline — a lot of the land may already be spoken for, and a lot of nonconforming projects may already be under construction.

Remember: every market-rate housing project takes away land that could be used for affordable housing. And at this rate, there is no way the city can come close to meeting the goals set in the General Plan, which call for more than 60 percent of new housing in town to be available at below-market rate.

The supervisors need to step in, fast, and pass legislation barring any new development in the eastern neighborhoods until a final plan is in place. The land rush is on, and time is running out.<\!s>*

CHEAP EATS While y’all were at Burning Man, I was in the bathtub. I was taking a bath. I was floating in a swimming pool with a mojito in one hand and a grilled hot sausage on a long fork in the other. I was walking in a fog.

I was eating a popsicle, running naked through sprinklers, stepping on worms.

I was listening to Elton John. In my room. Window open. I was eating salad and salad and salad. The greens were green and crisp, the tomatoes not quite ripe.

I was slicing white onions. I was eating white onions, raw, and hot peppers. I slept real hard and figured out how to open my window and walked around in the sun and the shade, looking people in the eye.

I took a bath and a shower at the same time, and drank ice water out of a glass, the outside of which frosted over, so I licked it. I dressed conservatively.

I hung out in coffeehouses. I am writing this in coffeehouses. Coffee. Iced coffee. Green tea. Italian sodas. This morning I went to a different coffeehouse, and I tried to see if I could eat Korean barbecue with rice for breakfast, in a coffeehouse.

I could! While y’all were at Burning Man, I was at the Pebbles Café in Glen Park, at 8:30 in the morning, eating bulgoki over rice, with a salad. Bulgoki, or bulgogi, means "fire meat" in Korean. In this case it’s beef, very thinly sliced and marinated in something salty and sweet, with onions and peppers and carrots and ohmigod! For having this on the menu, and for serving it to me at 8:30 a.m., Pebbles Café is my new favorite coffeehouse.

I think that people are vegetarians. I say this because I was sitting at a table full of dudes in a different coffeehouse, and they started talking about Burning Man this, Burning Man that. So I cleared my throat. I told them my idea for bringing Camp Chicken Farmer to Burning Man. They looked at me like I was crazy, and I looked at them like they were vegetarians.

The idea for Camp Chicken Farmer ’08 was hatched at Camp Trans, while I was interviewing someone about why didn’t they have eggs. And they said it was too hard to keep eggs without refrigeration, or even ice. Thing is: the freshest egg in the world is as warm as a mug of coffee, and the freshest meat is still moving.

To illustrate this natural fact, I am going to take Camp Chicken Farmer to Burning Man next year, if I can raise the funds and recruit farmers. So far I have one. Well, by myself then, if necessary, I’m going to haul a pick-up truck of live chickens to Black Rock Desert, and a sack of feed, and a hatchet. I’m going to dress conservatively, stay sober, and just fry fresh eggs and butcher and barbecue all week long, go to sleep early.

Now, my attentive readers are going to go: "Wait a minute, Chicken Farmer, you had a hard enough time killing Houdini."

Exactly. And what’s the cure for not hardly being able to kill a chicken? Killing hundreds of them. Anyone could tell you that. On the other hand, it takes a paid professional specialist like me to tell you about the intricacies of coffeehouse Korean barbecue in Glen Park. For breakfast.

Two drunk guys on a sidewalk in Chicago got in my face. They asked impolitely if I was a transvestite.

"I’m everything," I said. "I’m trans."

"You mean you used to be a man and now you’re a woman?" one guy asked while the other started going on about how God made you one way. "You don’t mess with that," he said.

"I did," I said.

The light changed while they were still in my face. "I’d love to stay and chat," I said, flashing them the peace sign and stepping in the street, as if I had somewhere to be.

In fact my bus didn’t leave until two a.m. I had time to kill. The sun was just setting. The tops of the tall buildings were lit, and we were in it, in one sense, like ants under a magnifying glass. I had time to kill, and time was killing me. So while you were at Burning Man, I was still in Chicago on the sidewalk between bums, drunk, hungry, discussing theology, not giving anyone any hand jobs, laughing, and on fire.<\!s>*

You’d think that this was a Republican town, with the way the local news media have been bashing not only the left but also some of the better, more effective, and more functional progressive institutions in San Francisco. I wouldn’t waste my time with this stuff, but there are real issues here.

I woke up Aug. 21 to a San Francisco Chronicle headline proclaiming "Anti-gentrification Forces Stymie Housing Development." The piece, by Robert Selna, opened with the sad, sad tale of a poor auto shop owner who wants to "build eight apartments and condominiums on an empty lot next to his Mission District auto shop and rent some of the apartments to his mechanics."

Well, it turns out that the evil Mission Anti-Displacement Coalition is fighting that plan, Selna reported, "insisting that [the] project not go forward until the city evaluates how new development on the city’s east side will affect industrial land, jobs, and housing."

The message: a little entrepreneur is getting hosed by a big, bad "not in my backyard" group that wants to stop new housing. The implication (and this is just the latest example of this stunning lie): the left in San Francisco is against building housing.

Well, for starters, MAC is playing only a modest sideline role in fighting the 736 Valencia project, a five-story structure that is designated legally for condos and includes no affordable housing. The real opposition is a group called Valencia Neighbors for Community Development. The issue, Valencia neighborhood activist Julie Ledbetter said, is that as many as nine new market-rate housing projects are in the pipeline for a short stretch of Valencia, and they shouldn’t be approved one by one without any regard for the cumulative impact.

MAC activist Eric Quezada told me that the organization has indeed taken the position that the city shouldn’t go forward with any more market-rate housing projects until it’s completed a legally mandated environmental study of the cumulative impacts of high-end condos on displacement, blue-collar jobs, and overall land use.

But that doesn’t mean MAC is against housing.

In fact — and this is the killer here — MAC emerged in the dot-com era almost entirely out of the nonprofit housing community. Some of its earliest and most prominent members were (gasp) housing developers. Just for the record, nonprofits have built something like 25,000 low- and moderate-income housing units in this city in the past 25 years. That is housing the city needs, housing that meets the city’s own clearly stated goals. And the progressives, people like the MAC members, are essentially the only ones who have built any affordable housing in the city at all.

Selna told me that he didn’t write the headline and "isn’t taking sides in this." I realize it’s not all his fault that he’s stumbled into a political hornet’s nest — but he has.

Then in the Aug. 22 SF Weekly, Matt Smith wrote that the left is turning this city into nothing but a tourist trap by promoting "a price-goosing apartment shortage of 30,000 to 70,000 units." That’s what, 140 giant new towers, or 7,000 10-unit buildings … that will go where? And what if (as is likely) rents still don’t come down? (Smith had no comment when I called him.)

And now C.W. Nevius of the Chronicle wants to shut down the Haight Ashbury Neighborhood Council Recycling Center so that homeless people won’t have any money … and will what — panhandle more aggressively? Break into cars? Makes perfect sense to me.

I talked with a Zombie

The busiest guy with an undead name in showbiz? Rob Zombie. Like a certain mask-wearing maniac, the man can’t be stopped – at least when it comes to doing press for Halloween, his latest film, which opens Friday, August 31 (giving you a full two months to prepare for the actual holiday). I zoomed into the office after an ill-advised night out for my 8:45 a.m. interview. My phone was lit up like Vegas – Mr. Zombie was running a bit late, could I hold on for a few minutes? Yeah, I could hold on to talk about Halloween – John Carpenter’s 1978 original is my go-to favorite film citation, and I’m anticipating the remake with every bloody bone in my horror-geek body. I don’t like doing interviews before I’ve seen the film, but again – it’s Halloween, dude. A movie that – let’s be honest – needs no enhancement to be scary, even in 2007. But I’m willing to see what Zombie has to offer. Which leads me to my first question …

San Francisco Bay Guardian: What do you think makes you different from other directors who’ve remade horror films (see: The Hills Have Eyes, Dawn of the Dead, The Texas Chainsaw Massacre, The Fog, etc. etc.)? I know you’re a huge horror fan…

Rob Zombie: It’s hard to say. All directors are different. And for me to assume I know who they are and what they do and what their motivations are would be presumptuous on my part. But the only thing that I know is that what makes this remake possibly different from others is that it’s not just a job. If you’re gonna take on something, you have to take it on because you have some passion for the project. Because I’ve been offered other things in the past and I’ve turned them all down because I was just kind of like, “Why would you remake that? Who give a shit?” So I mean, maybe that’s different. Sometimes people just take on jobs that they really don’t have a passion for, and it shows.

Concierges on the cheap

The concierge desk in the lobby of the Sir Francis Drake Hotel was doing a brisk business on a recent Sunday afternoon. Located a few strides north of Union Square, the Drake is best known for its colorful doormen, who work the curb out front in cartoonishly red costumes. But on this day the doormen seemed to be just killing time, while the concierge, a tall blond named Jill Schultze, was dealing with the long line inside.

"How can I help you?" Schultze asked the elderly couple at the front of the queue. They told her they were interested in taking a bus sightseeing tour. She looked pleased, recommended a specific tour of the Napa wine country, then picked up her phone to make the reservation.

"That was easy," the wife said once the transaction was complete.

For the next half hour, Schultze — whom I watched from a nearby chair without her knowing that I was a journalist — set up one bus tour after the next. In fact, that’s all she seemed to do — or, at least, all she did well. When a party asked for a recommendation for Indian food, she suggested the nearby Naan-N-Curry on Eddy Street, a restaurant that (apparently unknown to her) closed down last year.

One might expect better of a concierge at a place like the Drake, which boasts a AAA three-diamond rating. But the Drake is one of many hotels in San Francisco that have decided professional, in-house concierges are too expansive to bankroll. Instead, the hotels are starting to lease their concierge desks to outside companies, often charging $1,000 a month for a spot in their lobbies. The outside companies, most of which are established vendors in the tourism world, happily incur the cost — and the responsibility of the desk — in exchange for exclusive access to the hotels’ clientele.

Tower Tours, the bus sightseeing company affiliated with the Drake, is the largest player in the growing outsourced concierge business. The company has created a sister enterprise called Tour Links, which runs the concierge desks at five San Francisco hotels: the Drake, the Argonaut, the Best Western Tuscan Inn, the Hyatt Fisherman’s Wharf, and the Hotel Whitcomb. Tour Links concierges like Schultze can range from longtime professionals to summer interns. They’re rotated from one hotel to the next, depending on how well a particular hotel likes them and where the holes in the Tour Links rotation might be. According to one former employee, Tour Links concierges are required to book Tower Tours bus sightseeing trips. The employee told the Guardian the concierges are required to book a minimum number of tours per month, although higher-ups within Tour Links deny there are quotas.

"Our tour desk do provide information about Tower Tours," Hagen Choi, the president of Tour Links and Tower Tours, conceded, speaking in choppy English. "But our concierge also provide high-level service. As long as guests get good service, it doesn’t matter who operates the desk."

Laura Meith, the assistant general manager at the Tuscan Inn, had high praise for the service Tour Links provides. She said her concierges are well-informed, loyal, and outgoing. But Meith also admitted that she worked for Tower Tours as a concierge in 2004 (before the bus sightseeing company formalized Tour Links). She said she was thrown into the fray with little training — "I quickly discovered Zagat and Google and really just utilized those resources" — and said she was denied tips and commissions.

"Basically, concierges can make commissions on anything they sell," Meith said. "At an outsourced concierge desk, the concierges don’t make the money, the company does. The incentive is to drive the sales." She added, "From the guests’ perspective, they don’t know, nor do they care."

The Holiday Inn at Fisherman’s Wharf and the Radisson Wharf both currently lease their desks to Airport Express, the mom-and-pop shuttle company that competes with Lorrie’s Airport Service. Like Tower Tours, Airport Express has created a sister enterprise, Concierge of America, to handle that responsibility. Gil Sherabi, Concierge of America’s head concierge, told us his company allows its concierges to keep their tips and doesn’t mandate any sales quota. They do, however, exclusively book Airport Express tours; it wouldn’t make financial sense if they didn’t.

"We only care about serving the customers," Sherabi said. "We don’t have any quotas on anything. As long as the hotel is happy, we’re happy too."

The Hyatt Regency has handed over its concierge desk to Presentation Services, the company that manages the hotel’s event technologies, such as stage sets, projectors, and audio-video. Presentation Services runs the desk in exchange for the business the hotel provides it. The four-star Westin Market Street leased its concierge desk to Tour Links until last week. According to several inside sources, SuperShuttle, Lorrie’s, and Airport Express are in a bidding war to fill the vacancy.

And then there’s Shell Vacations, the nationwide time-share company that owns the Donatello Hotel, the Inn at the Opera, and the Suites at Fisherman’s Wharf. Concierges at each of these locations are required to cajole guests into taking time-share tours for Shell Vacations. Shell Vacations also runs the concierge desk at the Sheraton Wharf, where its concierges pull the same stunt.

"Our concierges do have quotas they have to meet," Yvonne Merzenich, the assistant general manager at the Donatello, said. The sales center "has negotiated packages with local restaurants, so that if guests want a nice meal, we’ll offer them $100 off that meal if they go to one of our time-share presentations."

Professional, in-house concierges are understandably concerned about the long-term viability of their jobs and the impact of outsourcing on their reputations. I met with one member of Les Clefs d’Or, the prestigious concierge association, who called this new wave of outsourced concierges "un-American and absurd." Another told us that hotel managers need to get their priorities straight.

"It’s a difficult situation because the concierges do not generate revenue," she said. (All the concierges quoted in this story requested to remain anonymous, as they’re prohibited from speaking to the media without the consent of their hotels.) "But the concierges provide the services that the guests come back for. You can’t put a dollar amount on all that we provide."

Whether guests feel that way is a different matter. I caught up with Sandra Curtis, a tourist from New Castle, Australia, who was staying at the Drake recently. When I told her that the concierge who had just helped arrange her bus tour worked for a bus tour company, Curtis was unfazed.

"The concierge was very helpful," Curtis said. "And that’s the way it’s happening now, isn’t it? We’re from Australia, and everything’s outsourced there too."

Susan McDonough, a fellow Drake guest from Cairo, Egypt, was less enthusiastic.

"I question [whether] if I ask the concierge anything else other than about bus tours, will she work just as hard?" McDonough said. "It’s a way for the hotel to cut corners. I don’t like it."

Last year the Wall Street Journal was the first mainstream media outlet to identify the outsourced concierge phenomenon. In a story headlined "The Concierge’s Secret Agenda," the Journal revealed that many of America’s top hotel chains are leasing their concierge desks to third-party employers. The chains include Hyatt, Marriott, Starwood, and Kimpton. Online travel giant Expedia.com had already acquired control of 38 concierge desks when the article hit the streets. Ticket vendor Vegas.com had obtained control of six desks, with plans to open up shop in several dozen more hotels in 2007. As many as 15 hotels in Manhattan had already caved in, and there were more in places like Chicago, Orlando, Las Vegas, and San Francisco.

Unmentioned in the Journal‘s exposé was just how unruly the outsourced concierge game is in San Francisco. The national trend in the hotel industry is toward large-scale outsourced concierge providers, companies like Travelocity, Expedia.com, and Vegas.com. It’s the providers who are expanding their services and courting new hotels. But in San Francisco, midtier hotels are the ones driving the murky business. Many have leased their concierge desks multiple times, unsatisfied with the service they were receiving but unwilling to pay for better.

The Westin Market Street has switched four times, transitioning from in-house concierges to Gray Line Bus Tours, back to in-house, then to Tour Links. Last week the hotel fired Tour Links and is looking for another company to take its place. The Drake has switched outside providers four times as well. In just the past few years, it has fired Tour Links, hired Lorrie’s Airport Service, fired it, and rehired Tour Links.

Ed Gunderson, the Drake’s general manager, said his hotel outsources its desk because concierges are "pretty cost prohibitive" and "if you can find a really good [outside] company and can keep some autonomy over the concierges they bring in, it’s the best of both worlds." When asked if fluctuating from one provider to another is really the best of both worlds, especially for the guests, he replied, "Tour Links is providing a service we’re very happy with."

Adding to the turmoil is Choi. Most professional concierges we spoke to don’t like Choi. "He’s terrible and very litigious" was how one Les Clefs d’Or concierge described the Tour Links and Tower Tours president. "He’s scared the shit out of me." Many concierges associate the outsourcing phenomenon that’s costing them their jobs with Choi and Tour Links more so than with the hotels.

The Northern California Concierge Association has urged its members to strike back by enacting an embargo on Tower Tours bus trips. (There are three primary bus tour providers in San Francisco — Tower Tours, Gray Line, and Super Sightseeing — and each offers comparable sightseeing tours around the city, to the Napa wine country, and to Muir Woods.) The NCCA also won’t let Tour Links concierges join its ranks. "He can drink my blood, and I can drink his," one NCCA member said of Choi. "I think that’s a mutual feeling there."

Earlier this summer, I headed to Tour Links headquarters for a chat with the controversial Choi. I wanted to gain some general insights into the outsourced concierge phenomenon and some deeper ones into the operations of the city’s largest provider. No surprise: Tour Links and Tower Tours share the same headquarters, an impressive office on Beach Street with an unobstructed view of the Hyde Street Pier. I found Choi holed up inside, in a small, cluttered workplace. His desk was strewn with papers, and his walls were festooned with pictures of his daughter (a former Tour Links concierge) and a framed copy of the Wall Street Journal "The Concierge’s Secret Agenda" report. Choi had even highlighted his company’s name in the article.

To my surprise, I liked Choi immediately. He was funny and personable, and he spoke about his company with disarming candor. He told me that in 2003, Expedia.com came to town and started cutting deals with hotels behind the scenes. Once contracts had been finalized, he said, it approached tourism vendors looking for hands to run its newly acquired desks. With more than 20 years of hotel experience — among other things, he used to sell used furniture from hotels undergoing renovation — Choi recognized concierge outsourcing as the newest trend and jumped on the bandwagon.

"The industry is evolving all the time," he told us. "We have to go along with it."

Choi said Expedia.com is still the puppet master at most of the hotels where Tour Links operates. (Expedia.com officials didn’t return numerous calls requesting an interview.) Choi also confided that it’s financially tough to get by in the outsourced concierge business, what with having to pay a hotel for a service it should be paying the lessee to provide. He added that most outside concierge services in the city don’t have the financial resources to expand and that he didn’t know if Tour Links would still be around in a few years.

"We’ll see," he said, his eyes twinkling and blinking in rapid succession. "But if not me, it’ll be somebody else."<\!s>*

It’s all unofficial at this point, but I’m hearing that Mayor Gavin Newsom is (finally) getting ready to appoint a new city planning director, a fact that sounds like an uninteresting bit of bureaucratic business but is actually one of the most important decisions he’ll ever make. And it will impact everyone who lives in the city, for years to come.

The director of city planning holds an immensely powerful job in this town. You wonder why there are too many cars on the streets and too many tall office buildings downtown, why there’s not enough affordable housing and not enough open space, why Muni is overcrowded and doesn’t run on time? I can trace all of those problems back to decisions made by the city’s planning directors over the past several decades.

In theory, the director reports to the Planning Commission, which sets policy on things like desirable types of development, where offices should go, where blue-collar jobs should be protected, and how many new people can be crammed into a geographic area without overwhelming the capacity of the streets and the transit systems. The way city planning textbooks talk about the job, planners develop visions of urban space, looking at what patterns of land use and development will improve the quality of life in a community, then set zoning rules to foster those visions.

In reality, here’s what’s been happening under the incumbent, Dean Macris, in San Francisco:

A developer who wants to make a lot of money building a project — these days, probably a high-rise full of expensive condos — hires a fancy architect and comes to the planning director with a proposal. The fancy architect talks about (to use the sort of language you actually hear inside the Planning Department) "a tall, slender shaft rising between the mounds of the downtown skyline" — no, I didn’t make that up — and next thing you know, Macris is in love. Oooh, he wants that tower — so he and his staff devise planning rules and guidelines to make it possible for the developer to build it.

(Of course, the way the Planning Department budget works only encourages that sort of behavior. Much of the money to run Macris’s fiefdom comes from developer fees. No developers, no fees.)

Then the activists come along and demand that the developer kick something back to the community. So the developer — who stands to make an absolute killing on the project — throws a few dollars around for a little bit of affordable housing and a few community amenities. And next thing you know, there’s an enormous high-rise under construction.

Developer-driven planning is, by definition, terrible. It was under Macris’s prior reign, in the 1980s, that something like 30 million square feet of high-rise office space was built downtown, driving up housing prices, attracting more traffic, overburdening Muni, and, since high-rise offices cost more to serve than they pay in taxes, hammering the city budget.

And now the city is poised to make some absolutely critical decisions about the future. We need a real planning director who isn’t a developer toady.

The search is down to two or maybe three candidates, at least one of them truly awful. And I hear from good sources that Newsom is listening to Macris’s advice on the choice. I fear for my city.<\!s>*

Their neighborhood

Some interesting mail landed in the boxes of Potrero Hill residents last week: flyers with a photograph of industrial stacks spewing plumes of pollution. They read, "Potrero Hill doesn’t need three more power plants in our neighborhood."

There’s a handy clip-out membership card to join the Close It! Coalition, from which you can "find out more about the city’s rush to judgment and their plan to put more power plants in our neighborhood." The return address on the card is 77 Beale, which isn’t in "our" neighborhood at all.

It’s the address of the downtown headquarters of Pacific Gas and Electric Co.

The utility, in the guise of a grassroots community organization, is opposing the contract that the San Francisco Public Utilities Commission is currently hammering out with a private company, J-Power USA, to build a new 145-megawatt, natural gas–<\d>fired power plant on a four-acre plot at 25th and Maryland streets. The plant would be owned and operated by J-Power for a period of 10 to 12 years, after which the title would turn over to the city.

This so-called peaker plant, one of three that would run when San Francisco’s power needs exceed the normal load, would be cleaner burning than Mirant’s dirty old Potrero Hill power plant, which city officials and environmentalists want closed. Mirant’s "Reliability Must Run" contract with the California Independent System Operator (Cal-ISO) could be terminated once the three peakers (whose generators the city received years ago through a lawsuit settlement) are built, according to the SFPUC.

Though PG&E, which has a questionable environmental record, claims to be against the peaker plants for pollution reasons, public power advocates say this is really opposition to the city owning its power sources. "PG&E has finally gone over the line. This is a good thing because this is so egregious and so transparent," said Joe Boss, a Dogpatch resident who received the mailer. "They’ll do all they can do to kill public power in San Francisco."

Boss and a group of neighborhood activists who support the construction of the peakers have put together their own mailer countering the claims of the Close It! Coalition, which has been dormant lately but was active prior to 2006, when community activists were fighting for the shuttering of PG&E’s Hunters Point power plant.

Other anti–<\d>public power literature also circulated recently in supervisorial district 11, where the California Urban Issues Project sent a flyer urging residents to oppose Community Choice Aggregation, the city’s gradual public power plan that is focused mostly on renewable energy sources. The mailer was apparently sent before the Board of Supervisors voted to approve the plan, which it did in June.

Sup. Ross Mirkarimi, who coauthored the CCA legislation with Sup. Tom Ammiano, called the CUIP flyer "shameful" and told the Guardian, "This is signature PG&E, but it’s not just PG&E. It now very well implicates the [Gavin] Newsom administration either with complicity or silence." The CUIP board includes Committee on Jobs director Nathan Nayman, small-business advocate and Newsom appointee Jordanna Thigpen, Democratic Party political consultant Rich Schlackman, Golden Gate Restaurant Association executive director Kevin Westlye, and other Newsom supporters.

Newsom signed the CCA legislation but tacked on a letter vaguely expressing concerns about the plan. He recently authored a letter to Cal-ISO expressing his support for the peaker project. While PG&E is opposing peakers here, it has plans under way to build at least two farther south, near communities it is also battling.

The San Joaquin Valley Power Authority has filed a formal complaint against PG&E with the California Public Utilities Commission regarding how the utility is conducting itself as the community moves forward with a plan for public power.

The SJVPA is a group of 11 cities and two counties, representing about 300,000 citizens, that has filed a plan with the CPUC to purchase its power through a CCA plan. Assembly Bill 117, written by Sen. Carole Migden when she was in the State Assembly and made law in 2004, allows communities to act as their own wholesale power customers and purchase electricity for residents.

San Francisco, Marin, Berkeley, Oakland, and Emeryville are working on CCA plans, but the SJVPA is the furthest along. With CCA, power is still transmitted by utility companies, but residents pay their electricity bills to the city. The SJVPA plans to build its own 500 MW power plant — which PG&E also opposes, claiming studies show it isn’t necessary — and has issued a request for proposals from interested companies for 400 MW of renewable energy. It estimates citizens would save about 5 percent with CCA.

But representatives of PG&E have been attending city council meetings in the area and even holding their own informational workshops at which they refute elements of the CCA plan.

In a lengthy memo sent to a Hanford City Council member and very similar in tone and content to one distributed to San Francisco nonprofit organizations a couple of months ago, PG&E offers misleading claims such as "Over 30 percent of PG&E’s supply comes from a diverse portfolio of renewable energy … about 20 percent comes from PG&E’s large hydro system, and approximately 12 percent comes from smaller renewable generation sources."

But according to state law, a large hydro system does not qualify as a renewable energy source — a rule the utility doesn’t apply to itself but is quick to point out a paragraph later when it attacks the CCA plan for renewable energy.

The SJVPA complaint details several examples of PG&E spokespeople cautioning against the plan in local media and at public meetings. CEO Peter Darbee even penned an editorial for the Fresno Bee in which he wrote, "The fundamental problem with the program is that the numbers don’t add up," a statement he attempted to clarify with unsourced data showing that rates will go up even if the CCA plan says they won’t. Darbee went on to say that PG&E is just looking out for the best interests of the people.

The Fresno City Council recently voted 4–<\d>3 not to join the SJVPA, a close vote that "was based in large part on PG&E raising questions," said David Orth, the general manager of the Kings River Conservation District, which is overseeing the implementation of the CCA plan. "That is their intent, frankly — to clutter the discussion and decision-making field with a lot of uncertainties and threats of complexity."

Fresno would have been the largest consumer of power in the coalition, using 45 percent of its electricity.

Orth said obfuscation has been the utility’s tool, coupled with reassurances that power "is too difficult for you to understand, so accept the status quo."

He said PG&E hasn’t been entirely factual with its advice and cited a specific example in which PG&E claimed that if a community opted out of CCA after joining, it could be liable for as much as $11 million. "It was a fabricated number, and it was a fabricated scenario, but it lead certain council members to believe there was a risk we weren’t explaining," Orth said.

Lawyers representing the SJVPA say the utility is using ratepayer funds for its anti-CCA marketing, and that’s a violation of the CPUC’s rules. AB 117 states clearly that utilities should cooperate fully with municipalities enacting CCA plans. In a December 2005 decision seeking to clarify how CCAs will be implemented, the CPUC wrote, "There is little if any benefit from permitting a battle for market share between CCAs and utilities. Of course, we expect utilities to answer questions about their own rates and services and the process by which utilities will cut-over customers to the CCA. However, if they provide [sic] affirmatively contact customers in efforts to retain them or otherwise engage in actively marketing services, they should conduct those activities at shareholder expense. We do not believe utility ratepayers should be forced to support such marketing."

"SJVPA is informed and believes and thereon alleges that these marketing and related activities were undertaken at PG&E’s ratepayer expense to compete against SJVPA," the authority’s lawyers wrote in the complaint to the CPUC.

Even if PG&E is drawing from the proper budget for the marketing, the appearance that it isn’t needs to be addressed, and the SJVPA complaint further calls on the CPUC to clarify its rules on what utilities can and can’t do. Local customer representatives, usually salaried by ratepayer funds, are telling folks to stick with PG&E, and that’s a betrayal of trust. "You have someone who’s worked with a customer for years and years and years saying, ‘Don’t support CCA,’<\!q>" Orth said.

PG&E, which has disputed the allegations in the SJVPA complaint, did not return our calls seeking comment. The two parties are currently in mediation, and SJVPA attorney Scott Blaising said the utility has yet to provide solid evidence that ratepayer money isn’t footing the bill for the anti-CCA marketing. Southern California Edison Co., which provides about a quarter of the SJVPA’s current power, has not been as contentious as PG&E, Orth said.

"Theoretically, [anti-CCA marketing] should be covered by shareholders," said Bill Marcus, an energy consultant who works with the Utility Reform Network. "Realistically, a bunch of it leaks into ratepayer accounts."

He pointed out that PG&E’s budget allocation for local public affairs has stood at 22 percent over the course of several general rate cases, despite clear peaks in marketing for certain campaigns.

Some San Franciscans will be closely watching what happens next as a sign of things to come as this city moves forward with its CCA plan. As Mirkarimi told us, "What San Joaquin is experiencing is likely a prelude to what San Francisco will be confronting as it pertains to PG&E’s desire to deny CCA and San Francisco’s pursuit of energy independence."

Migden, who wrote the CCA law, said, "PG&E’s alleged actions controvert the letter and the spirit of the bill. The utility and the SFPUC should take heed, because green public power is the people’s passion."<\!s>*

When the big earthquake, terrorist attack, or other civic disaster finally hits San Francisco, a lot of people are going to be in for a major shock: their high-tech cell phones and computer-based office telephone systems might not work.

But after the 1989 Loma Prieta quake and after the Sept. 11, 2001, terrorist attacks in New York City, residents found there was still a way to reach their loved ones and let the world know they were OK; they used an old-fashioned communications tool that’s low tech, securely grounded, publicly accessible, and reliable.

It’s called a pay phone.

Next time there’s a disaster, we may not be so lucky: pay phones, fixtures of the public landscape for more than a century, have been quietly disappearing. And many of those that remain don’t work. These essential communication tools — good for emergencies, privacy, and the poor — are falling victim to deregulation laws, the greed of telecommunications companies, and the public’s obsession with high technology.

In San Francisco they’ve departed in droves from sidewalk carrels; corner stores; bus shelters; subway platforms; office, museum, and movie theater lobbies; supermarkets; shopping malls; city swimming pools and YMCAs; diners; parks; and gas stations. They’ve been disappearing at a rate of about 10 percent annually for the past four years, down from roughly 400,000 at the height of the dot-com boom to 150,000 today, trade group attorney Martin Mattes told state regulators last year. The decline in San Francisco mirrors those in California and the nation.

And while pay phones may seem like quaint relics of another era, they remain an important part of the nation’s communications system, serving millions of people who for one reason or another don’t have or can’t use cell phones. And consumer advocates say the loss of the pay phone system is a serious problem.

Although cell phones are pretty ubiquitous, not everyone can afford one — and not everyone can use one. For socially marginalized people, pay phones are still a lifeline. For people who can’t use wireless technology — and can’t afford a home phone line — they’re essential.

Why are pay phones vanishing? The ready answer — cell phones — identifies the technology that’s replacing them and cutting into their profits. But it doesn’t completely explain why a society that once valued pay phones — and may ultimately remember that it still does — has let them disappear. That story has more to do with the politics of deregulation and the profits of telecom companies.

THE POWER OF OLD TECH


In the 2004 climate-change disaster film The Day after Tomorrow, Dennis Quaid plays a climatologist who anticipates dire consequences from a sudden oceanic temperature drop, which is triggered by global warming and leaves New York City frozen solid. From the beaux arts NYC Public Library where he’s taken shelter, the Quaid character’s son (played by Jake Gyllenhaal) needs to call Dad in Washington, D.C., but the cells don’t work. So he finds a half-submerged mezzanine pay phone with a dial tone ("It’s connected to the telephone lines," he notes brightly), drops in a couple of coins, and bingo — he gets Dad’s insider travel advisory.

Such a scenario — at least the pay phone part — isn’t science fiction. In fact, it has played out like that in NYC a few times and also did so in New Orleans after Hurricane Katrina hit in 2005. When the Twin Towers went down Sept. 11, cell phone masts went down with them. Lines were endless as outgoing calls from lower Manhattan funneled through two nearby landline pay phones, as reported on NBC’s Today. Ditto in the summer heat wave of 1999, when New York air conditioners on overdrive toppled wireless transmitters like dominoes, silencing cell phones from NYC to the Great Lakes. Landline telephones — including pay phones — continued to ring. And when the waters rose in New Orleans, residents flocked to pay phones made available for free use to contact loved ones and let the world know they were stranded.

Landline pay phones — like wired home and office phones — are simply more durable and reliable. "I love my cell phone," said Natalie Billingsley, who heads the California Public Utilities Commission’s Division of Ratepayer Advocates. "But I wouldn’t give up my landline. There’s not enough [wireless] network redundancy."

When the Loma Prieta earthquake hit the Bay Area in 1989, electricity and cell phone service were out for hours, but, Billingsley said, "landline phones were back up in 10 minutes."

Regina Costa of San Francisco’s the Utility Reform Network recalled that when the quake trashed Pacific Street in Santa Cruz, the public switch connecting local phones to the larger network worked despite a local power outage.

The reason, Costa says, is that the traditional wired phone network has a robust, independent electrical backup. Not so wireless transmitters and cable fiber-optic systems, both powered by the public grid.

"Wire lines are a really big public safety feature," Billingsley told us. Backup generators at switching points, where regional and long-distance lines converge, create "all kinds of redundancies" for rerouting calls if parts of the network go down.

That’s not just a technological issue. The new tech networks lack robustness and redundancy, Billingsley said, in part because such standards are no longer mandated. Before telecommunications were deregulated, companies were required to pay for reliability. Now reliability is no longer a public service. Under deregulation, reliability is more spotty. Last year state legislators addressed the need for adequate backup power-pack standards for Internet phones — but in the end, consumers will need to buy the backup systems.

In Japan, where the old but vital wired pay phone network has been reduced by more than half (from 910,000 to 390,000) since the public phone company was privatized in 1985, a public safety official recently warned against such shortsightedness. "To remove public telephones amounts to decreasing the means of communication during emergencies," disaster prevention program director Hitoshi Omachi of Yokohama’s Chiiki Bosai Laboratory observed in a May 8 Asahi Weekly article about cell phones overtaking pay phones. "People should think about measures to maintain public phones, including financial assistance from the central or local governments."

Then there are the social issues. Beth Abrams, director of Grupo de la Comida, which feeds 2,000 immigrants and refugees in the Mission each week, said many are dependent on pay phones. "The thing to remember," Abrams told us, "is that a pay phone could mean somebody’s life in an emergency, when time is of the essence." A child suffering an asthma attack or an adult with heart disease or diabetes (the occurrence of which is high in the immigrant community) "often needs immediate response and has difficulty walking far," Abrams said. Many people whom her group serves don’t have cell phones and rely on pay phones when caring for children outside the home or answering job ads.

Howard Levy, attorney and executive director of Legal Assistance to the Elderly, which serves about 1,000 clients a month, told us many seniors in the Tenderloin and in SoMa hotels don’t have home phones or cell phones. Besides the disincentive of cell phone cost, "folks beyond a certain age don’t feel comfortable with the technology," which is not designed for people "whose vision isn’t so great," Levy said.

Jennifer Friedenbach of the Coalition on Homelessness told us that "a lot of folks do have cell phones nowadays, on a prepaid card," but have only intermittent access, and none when the card runs out. "Poor people in general — people who have extremely low incomes — even if they have a phone at home, [it] can be shut off at times," she said. "Pay phones are really important for emergency situations for folks living outside," or when homeless people are first on the scene, to report an emergency.

In an impromptu survey of eight clients at the Independent Living Resource Center, a San Francisco disability-rights advocacy and support group, services coordinator Diane Rovai found three who had been seriously inconvenienced by lack of pay phone access. One needed a ride home from the airport and was stranded after an entire bank of pay phones was removed; another "missed a really important meeting" after getting wrong directions (the phone she finally found "was dirty and not in good repair"); and the third, who has no cell phone, has problems when she goes out to meet people.

"There are still people who depend on pay phones," particularly in rural communities, Anna Montes said. She belongs to San Francisco’s Latino Issues Forum and is a member of the PUC advisory committee on Universal Lifeline Telephone Service, which subsidizes phone service for low-income households.

Four percent of state households don’t have basic phone service, she said, and many of those are poor and Latino and rely on pay phones.

"Pay phones should be supported because there are individuals who can’t afford [cell phones] and places where wireless doesn’t work," said Bill Nussbaum, a telecommunications lawyer at TURN. "Public policy is a reason to wrap [pay phones] into the goal of universal service, the concept of maximum penetration with reliable and affordable phone service for all."

THE END OF PUBLIC SERVICE


One reason the government has allowed pay phones to disappear is that most people don’t think about them. Cell phones often seem like all one needs to stay in touch, at least to those who own them.

"There’s an unfortunate assumption that everyone has a cell phone. It’s not true," said Harold Feld, senior vice president of the Media Access Project, a Washington, D.C., nonprofit public interest media and telecommunications law firm.

Regulators used to feel it was important for people to have access to public phones, but "they don’t think it’s important anymore," he told us.

Feld pointed out that pay phones used to be owned by AT&T, which created and maintained the pay phone network as part of a widely accessible phone system. Government-guaranteed profit on the company’s investment essentially subsidized even those pay phones that weren’t profitable, an arrangement institutionalized by the 1934 Telecommunications Act. Moreover, as a regulated public utility, the phone company needed permission to get out of the pay phone business.

With the monopoly’s breakup in 1984, competitors could enter the pay phone market, and by 1996 AT&T could get out of it.

"The old Bell monopoly came with a historical sense of public service that did not survive the [company’s] breakup and the new cost-benefit accountants and the MBA bottom-line artists," technology historian Iain Boal, coauthor of Afflicted Powers: Capital and Spectacle in a New Age of War (Verso, 2005) told us. "Under neoliberal economic doctrine, all public goods are suspect."

Boal noted, "The new telecom companies had little or zero interest in the public phones they inherited. In fact, quite the reverse. It was in their interest to close or leave trashed any boxes that weren’t profitable and in general to force laggards to mobile phones."

It didn’t happen immediately, attorney Mattes, who has represented the California Payphone Association, a trade group, told us.

"Because the pay phone business was still pretty good in the late 1990s, the telephone utilities stayed in the business during those years, competing with the independents," Mattes said. Pay phone rates also rose.

But the economics of the pay phone business started to change around 2000, Mattes said, mostly due to wireless competition, and companies had difficulty collecting for toll-free calls and calls made through other long-distance providers. So telephone utilities started giving up their less-profitable pay phone locations.

"Bell South abandoned the pay phone market entirely about five or six years ago," Mattes said. "AT&T and Verizon have been gradually leaving the market, giving up their less-profitable pay phones at a steady pace."

From January 2005 to June 2007, AT&T reduced its pay phone lines in California by more than half — from 77,467 to 36,870 — according to PUC counts. And in the same period, Verizon went from 28,743 to 16,421 pay phones.

While the pay phone business was "modestly profitable," according to Mattes, it was mainly important to the utilities "as a platform for customers to make highly profitable long-distance calls." But, he said, with competition in long-distance and wireless services, the profits have been squeezed out of long-distance calls. Pay phone use also dropped dramatically, he said, due to wireless competition.

TURN’s Costa suggested that the old AT&T overpaid in its postdivestiture bid to acquire cable and bypass local exchange carriers for direct connections with its former customer base. Later, it abandoned the poor voice-quality network and may have needed to recoup losses.

"The Bells have a separate incentive to pull out copper," the older coaxial wire that connects almost all landline phones, Feld said. "The FCC says they don’t have to share [fiber-optic cable wire with competitors] as they do copper, and copper needs to be maintained. It was laid because regulators made them. It’s more costly to maintain than they can charge."

"Without regulation," Feld noted, "big companies can leave the [pay phone] market, but they can also increase line charges" — monthly fees for phone connection to the local exchange — "and interconnection fees" for long-distance connection, paid by callers and local exchanges to the nonlocal carrier for allowing calls to go through.

The loss of pay phone service is one more result of faith-based deregulation, the belief that the market will provide for everyone’s needs. "The demise of pay phones was utterly predictable," Boal told us. "It’s a disgrace."

And the impact of the disappearance of pay phones ripples beyond service needs.

OUTSOURCED


A sprawling ’70s low-rise cement building at West Portal and Sloat, once hidden by shrubs from view of the adjacent Muni tracks, is now vacant and slated to become the new Waldorf High School. It used to be the Pac Bell operators’ building, housing 35 workers, mostly women with more than 30 years of service, "the forefront of the [union] movement," said Kingsley Chew, president of Communications Workers of America Local 9410 in San Francisco.

Those operators answered 411 information queries and routed 911 emergency calls. Two years after winning a strike by shutting down the phone company, the operators saw their jobs outsourced in 2006 to Dublin and Pleasanton.

The majority of the local’s members are women, Chew said. Their male counterparts, mostly collectors in the coin department, are now gone, accounting for the loss of 25 to 30 union jobs in the past five years. Besides gathering coins from pay phones, the collectors maintained the phones and removed graffiti (which is more prevalent these days).

Pay phones once meant union jobs, and as their numbers have declined, so has the union. Local 9410 membership is down from 3,000 when Chew took office in 2003 to 750 today, with those still around mainly technicians who install and repair phones.

Chew calculated that one job here is financially equivalent to six jobs in India or the Philippines, where 1-800 calls are processed and workers are paid $400 a month. The city and the state lose local business tax revenues when jobs go overseas, he said, and the costs of vanishing pensions as workers are laid off are eventually externalized and borne by local residents when demand for public services rises.

There may be greater demand for pay phones soon: the major phone companies are expected to raise home-phone rates. Basic service rates have generally been averaged geographically, within a major company’s service "footprint," Lehman said, but deaveraging can soon occur, which will drive up the price of basic rural and high-cost urban services.

Meanwhile, two state programs supporting pay phones are being axed.

REGULATIONS DIE


Two pay phone regulatory programs remain on the books, one frozen and one barely operating. The PUC created both programs in 1990 as part of a legal ruling, when new pay phone providers were struggling to gain a foothold in former Pac Bell (now AT&T) and GTE (now Verizon) monopoly territory and consumers were encountering new system abuses.

One program, the Public Policy Payphone Program (PPPP, or Quad-P), was designed to subsidize phones located "in unprofitable locations to serve the health and safety needs of the public," while the other, the Payphone Enforcement Program (now known as Payphone Service Providers Enforcement), was established "to ensure that pay phone consumer safeguards are being followed." Both programs, which were expanded statewide, were funded by a monthly per-line surcharge on the industry, unlike other telecom public policy programs, which are supported by a percentage surcharge on consumers’ monthly phone bills.

But the list of potential state locations for subsidized pay phones was reduced from 67,000 in 1988 to 22,000 in 1989, just before the state programs were initiated, and to 1,975 in 1993. By 1998, when deregulation was complete and pricing went to market rates, Pac Bell had only 300 subsidized business phones out of 140,000, attributing the change to the increased number of independent providers and to multiphone contracts, which enabled revenues and costs to be averaged out.

Applications to designate or install Quad-P phones have to pass through the PSPE advisory committee, which hasn’t aggressively solicited them or approved more than two or three (with just one installed) of the 33 received since 2001, according to the Division of Ratepayer Advocates.

Almost nobody knows that Quad-P exists — or that anyone can file an application if a proposed site meets certain criteria. Currently, there are only 14 Quad-P phones statewide, mainly in parks, down from 40 in March, with 13 supported by AT&T and one by Verizon.

The PSPE was set up "to enforce, through random inspections, consumer safeguards for all public payphones … such as signage requirements, and rate caps for local, long distance and directory assistance calls within California."

Until recently, inspectors made the rounds of for-profit as well as subsidized pay phones, numbering more than 400,000 in the ’90s, on a rotation schedule that took a decade to complete. Between December 2001, when the project came under PSPE administration (it was formerly run by the industry), and June 2007, civil-service inspectors logged 133,893 violations on 39,444 phones, a rate that has slowed with staff downsizing. The DRA estimates its activities reduced the average rate of violations significantly. The inspection staff was cut in half last fall, to three, and other program staffers were transferred to other divisions to cut expenses.

The number of pay phones to monitor has declined, but with reduced inspections, violations have begun to rise. Numbering too few to be proactive, inspectors now respond only to consumer complaints registered on the PUC’s consumer fraud hotline. This number, not posted on pay phones, is 1-800-649-7570; it accepts calls between 9 a.m. and 3 p.m. Monday through Friday. There’s no after-hours message machine, but if you’ve got a computer and are still primed when you get home, you can log on to the PUC Web site, at www.cpuc.ca.gov, to report a complaint. Patterns of systemic abuse — and dead phones — are less likely to be detected from reactive, hotline-triggered complaints.

Last summer the industry’s PSPE advisory committee formally requested that both programs and the committee itself be eliminated and program surcharges ended, citing reduced activity and need. "All that Quad-P has done is subsidize its own costs," said Mattes, the attorney for the California Payphone Association. "It deserves a quiet burial."

The DRA argues that the reduction of these state programs is premature: even if dramatic market changes have made pay phones a distant second choice over wireless for many, the old technology is still important.

For one thing, predictions of the death of pay phones may be exaggerated. "It is likely that some core base of payphones will continue to be used regularly and earn a profit," the division observed in a July 2006 report, responding to gloomy industry forecasts.

For another, the actual basis for the pay phone network’s decline is far from clear. The division noted "a distinct lack of quantitative analysis regarding both the reduction … and demographic information about the location and need for payphones" in its program review comments, part of the PUC’s formal rule-making process (to be concluded in coming months, following administrative law judge Maribeth Bushey’s findings).

Acknowledging that "concerns about migration to wireless phone plans and cost recovery issues (including interconnection costs, phone card fraud, and 911 services)" need to be addressed, the division restated the universal service goals of both the ’96 act and the original 1934 Telecom Act, quoting a commission ruling from a decade ago, now more urgent: "Parties have not substantiated that telephone service will continue to be available at unprofitable locations to satisfy public health, safety, and welfare needs. Nor have they convinced us that the marketplace will replace the existing public policy payphones or fulfill the public policy objective in public health, safety, and welfare."

The DRA recommends a two-pronged strategy for stabilizing the for-profit market and assessing the need for subsidized pay phones — one that could potentially restore proactive inspections.

Instead of eliminating Quad-P oversight, it said, "the task, rather, is to address these problems by reforming and strengthening the program, as well as by assessing [systematically] the continuing public need for payphones" and finding ways to meet it. The division proposed a formal workshop or survey to compile data about profits and costs, locations, and demographics — hard data on where pay phones exist and where they don’t but are needed.

The DRA also suggests that regulatory oversight be overhauled; that the PUC exert closer control over pay phone service providers by imposing fines or through disconnection; that pay phones be registered or certified, as they are in numerous other states; and that new procedures be adopted for installing and removing pay phones.

Oversight is needed, the division says, even if the industry can’t pay for it; it recommends a surcharge on monthly phone bills, as there are for other public policy telecom programs. It also says an overdue audit of both programs is needed and that the hotline-triggered inspection regimen needs to be reassessed within 12 to 18 months of its inauguration last fall.

SAVING PAY PHONES


On the ground floor of San Francisco’s City Hall, a single pay phone remains among six phone bays. Under existing subsidy rules, the city — which contracts for multiple phones — is ineligible for a subsidy.

It seems like high time to figure out how to restore some conventional lines of communication. Instead of shifting the whole cost of backup phones to the public, why not consider allocating it between the industry and ratepayers, placing the industry’s contribution on a sliding scale to be reviewed every year or two along with revenues, and even incorporating a percentage of more competitive telecom video and cable profits?

Admittedly, this goes against the current tide. Avid deregulators — like former PUC commissioner Susan Kennedy, now Gov. Arnold Schwarzenegger’s chief of staff, and current commissioner Rochelle Chong — have aggressively promoted advanced technology and less oversight.

But is what’s good for AT&T and Verizon really good for ratepayers or small businesses? Letting the pay phone network — a real, decentralized public space — be dismantled just because many of us now have private cell phones violates fairness and common sense. Corporate-minded advanced-tech boosters may dismiss the older technology, but it serves everyone.

UCSF gives city planning the royal salute

UCSF, which is developing a huge new campus at Mission Bay, wants to put a new research facility a few blocks away on Third Street. The Pritzker Center would focus on mental health for kids, and I’m all in favor of that. Of course, it involves turning a vacant warehouse into essentially office and clinical space, which may violate the city’s attempts to preserve blue-collar jobs in the southeast neighborhoods, but we may never hear any discussion of that issue, or of any other planning-related issues, and here’s why:

In a remarkable Fuck You to the entire city of San Francisco planning process, UCSF has essentially declared that it doesn’t have to abide by any city planning procedures at the site.

This isn’t even part of the Mission Bay campus, which is already zoned for UC’s use. In fact, UC doesn’t actually own the building. So by any normal standard, UCSF would have to apply to the city planning department for environmental review.

No such luck: The school has done its own review, determined on its own that there are no environmental issues, and told the city planners to kiss off.

Maybe the Pritzker Center is a fine use of that space, but it’s a scary precedent that could set the stage for UC expanding far beyond Mission Bay, taking other property and turning it to campus use — without any meaninful community input.

Careers and Ed: A life of death

A kid gets killed in the cross fire of a shooting. Someone digs up a human skull while planting begonias. An elderly woman dies in her sleep in an apartment no one has visited in years.

In all these cases, somebody — or somebodies — has to examine the scene and, well, the bodies to find out what happened. And as any fan of hard-boiled detective stories, CSI, or Quincy, M.E. knows, those somebodies are the forensic team, perhaps most prominently the coroner.

It’s a mysterious job with macabre connotations, imbued with a mix of excitement and dread. A new show on Spike purports to show armchair detectives what it’s really like, with Grand Guignol bravado, but I always wonder, is that really how it is? So I decided to find out.

GOING DOWNTOWN


I start with our own fair city of night, only to discover that the subject of coroners is more complicated than I thought. What TV often portrays as one or two jobs is often many different jobs. And San Francisco County doesn’t have a coroner — a position defined as an elected or appointed government official who deals with deaths that raise questions. Instead, it has a medical examiner, whose office is headed by an MD or doctor of osteopathy. The difference may seem like semantics, but it’s an important distinction for people in the field.

I also learn that it will be next to impossible to meet San Francisco’s medical examiner, Dr. Amy Hart. Unlike her predecessor, Dr. Boyd Stephens — whose media accessibility and subsequent scrutiny led to controversies about the reuse of needles, improper ventilation against dangerous pathogens in autopsy rooms, misappropriation of funds, and sexual harassment — Hart is fairly shy when it comes to the media. Public controversy can be a downside to the job, whether it’s over the contested findings of Los Angeles’ fabled "coroner to the stars" or the unpopular study by Marin County’s coroner of suicides on the Golden Gate Bridge.

So I get the basics about the job from Hart’s deputy administrative director, Stephen Gelman, at the ’50s-era Medical Examiner’s Office on the grounds of the Hall of Justice. Gelman, a middle-aged, white-haired former special agent with the Department of the Treasury, explains the makeup of the office: 32 people, including forensic pathologists and anthropologists, toxicologists, chemists, investigators, and administrative personnel.

And becoming part of Hart’s team isn’t easy, especially since forensic-themed TV shows and the office’s involvement with UC San Francisco managed to attract 160 applicants during a recent call for three positions. Preference is given to those with a background in medicine and, at the very least, the funeral industry.

"IT’S CHINATOWN …"


But those are just the facts. My experience at the Alameda County Coroner’s Bureau, an art deco, cream-colored building on the outskirts of Chinatown, is much more visceral.

Inside I meet the genial Lt. Jason Arone, who explains that the bureau has been under the jurisdiction of the Alameda County Sheriff’s Office since 1989. That gives Sheriff Gregory Ahern the title of chief coroner, but on a day-to-day basis, Arone is the guy in charge. I also meet Mike Yost, a former detective who is now a public administrator, which means he handles the belongings of decedents, from pets to hidden stashes of money.

Downstairs, the morgue is pretty much what movies would have you expect: cold metal and antiseptic green tile. Arone pauses at the sound of a saw — we can’t go inside if there’s an autopsy under way. But it’s just carpenters fixing a door. Inside, I’m struck by the lack of sliding-drawer coolers — bodies are identified by photograph these days and are kept in less-obvious storage rooms.

Then I meet autopsy technician Smiley Anderson — sometimes referred to as "the bullet finder" by resident pathologists. The 25-year veteran started working in his family’s mortuary as young man in the South — much the way many in coroner’s offices got their start. But Anderson says the field is changing now. Crossover careers are rarer, and he says the best way to get in is through an education in medicine.

As I sit at his desk outside the autopsy room, I notice what Arone calls "the meat-locker smell." It’s neither the smell of embalming fluid that I associate with funerals nor that of decay — just a stale, permeating reminder of what’s inside.

OUT IN THE FIELD


It’s midafternoon when I meet Alameda County Coroner’s Bureau detective Eric Larson, who’s agreed to show me the other side of the job: going out on calls. I wait with the jocular thirtysomething until two calls come in.

One is a follow-up from the night before. A young girl and her brother were at the house of a family friend, which also serves as a rehabilitation facility; soon after dinner both fell ill. The brother recovered, but the young girl died. Larson decides to ask some questions, though the toxicology report is still pending.

The other call is a notification about a suicide on the Golden Gate Bridge. (Sometimes Alameda County representatives will handle calls for Marin County if the next of kin is in the East Bay.)

Larson puts on his flak jacket as part of his routine, and we get into one of the department’s cars. Since it’s not a pickup, he says, we won’t need one of the vans.

The first stop is at a sagging west Oakland house. The man who answers the door is barely coherent but sends us to Children’s Hospital. When we get there, I’m amazed to see the little boy we got the call about bouncing up and down, chewing on a french fry. When he sees Larson, he starts singing, "Bad boys, bad boys …" Larson laughs and says, "That’s my favorite song, buddy." The child’s hale liveliness is heartbreaking with the knowledge I have of his sister.

Larson asks the family friend, who’s at the hospital, for any information on the night before. It’s unclear whether he’ll get answers, and he tells me that sometimes he never does. In fact, that’s one of the hardest parts of the job. "It doesn’t matter how much science you throw at it," he says. "Sometimes it comes out undetermined."

It’s getting late as we head to the home of the suicide victim’s sister in Castro Valley. No one answers the door. Larson checks with the Marin County Coroner’s Office for another address, then stops by a dispatch office to get directions. Notification is important to Larson, as people may otherwise never hear about the fates of their loved ones.

We arrive in a quiet, ’70s-era housing tract in San Leandro, at the house of the victim’s mother. Again, no one is home, but a neighbor with emergency keys checks the house, determining that the victim’s mother has gone for a walk with her dogs. We wait at the house.

When she arrives, she knows what Larson’s going to say before he opens his mouth — but the news is no less brutal. When we leave, her neighbors are sitting beside her on the couch, friends from happier, simpler times.

It’s late when we return to the office, and Larson is supposed to work another swing shift tomorrow. But he gets a message from home. The son of a friend died in an accident. The funeral is tomorrow.*

Careers and Ed: Brew business

There’s a curious but significant distinction between a job and a career. A job is something that we (usually) spend a third of our life doing, (usually) in exchange for financial compensation. While a job is inherently meritorious, it also connotes trading time for wages: an eternally losing proposition. Unless it’s paired with "hand" or "blow," there’s a modicum of doom in our breath when we utter the word.

A career, however, seems to hold aloft our daydreams and aspirations. Careers are crafted, built, and achieved. And yet, if we work for too long without keeping focus on our passions, our career sometimes becomes that trap we fall into before we know it, the thing people associate with us but we don’t associate with ourselves. At that point, our career can become the dark mirror that reflects our failure to take a risk. It is our soul death.

So there’s nothing more inspiring than meeting someone who loves what he or she does and gets paid for it. Ultimately, it’s not about getting a high-paying job; it’s about having a career that makes you happy. Lars Larson, master brewer of Trumer Brauerei in Berkeley, is one of those lucky schmucks who are making it on their own terms.

Larson’s path to Berkeley and brewing Trumer Pils has been a long and rewarding one, and it seems to be the result of his paying attention to his instincts. It’s doubtful that any child sets out to oversee an artisan beer operation, but Larson admits he can’t recall a single beer he’s disliked, "even sips of beer I snuck from my dad’s glass as a kid."

Larson spent part of his high school years studying in Germany, where the legal drinking age is 16. Around the time he graduated from college with a history degree in the late 1980s, he became interested in what was then a burgeoning craft-beer movement. Inspired by the energy of artisan beer making and the chance to return to Germany, he relocated to Berlin to get a degree in fermentation sciences. It was 1990, right after the Berlin Wall came down. After participating in the historic events that followed, Larson accepted a job at a brewery in Argentina, where the light lager style of German pilsner was popular.

"The principles of brewing are the same worldwide, but culturally [Argentina] was a phenomenal experience," Larson says. "I wouldn’t trade those years for anything."

When he returned to America four years later, he landed in Longview, Texas, working for Stroh’s, which produces such beers as Schlitz and Lone Star. The company had a four-million-barrel capacity and more than 400 employees working in three shifts for an around-the-clock industrial operation. That was by far the most commercial beer-making environment he’d ever been in.

"There’s really a limited set of actions that occurs in the brewing process itself," he says. "But learning different aspects of the business was a great experience."

When the Stroh’s factory closed, Larson took a few interim jobs before accepting his master brewer post at Trumer. Now he’s part of the international team that’s helping to develop the Trumer Pils brand regionally and beyond.

Trumer’s roots are far from the Bay Area. Founded in Salzburg, Austria, in 1601, the artisan brewery established a second location in Berkeley in 2003 because of one thing the two cities share: soft water, an important component in brewing pilsners.

There’s also a historic connection between Berkeley and beer. "The mayor of Berkeley [Tom Bates] just came for a tour," Larson mentions. "He was the guy in the 1970s who helped push legislation to enable brewpubs in California, so in part he’s the reason why we’re here today."

And Larson is glad Trumer is here. Calling this part of the country a great place to live, he says, "People love good food and drink here, and we enjoy being part of that local movement."

But what does Larson actually do? Does a master brewer job entail what we think it does? "I work with great people, and it is great fun, but it isn’t just a frat party," Larson cautions. "It’s not slugging beer all day long."

Actually, it’s the variety in his job that makes it interesting for him. "I work on plants, foodstuffs, chemicals, and machines," he says. "There are different tasks to do each day, and because our original brewery is in Austria, I get to travel to Europe and speak German."

And though beer making is an ancient art, Larson says his work is more rooted in technology and the modern age than one might expect — though it also involves plenty of hard labor.

"It’s really an industrial operation, and there are a lot of safety considerations," Larson says. "There are chemicals, gases, steam, and fast-moving machinery. It’s hot, sweaty, dirty work, and a lot of times you’re beat at the end of the day. It’s quite physical work and not for everybody."

Larson says brewing’s future seems bright. It’s a rapidly growing profession, which means there will be more jobs like his in the years ahead. But since "it’s a job that’s pretty high up on the list," newcomers will need to get in on the ground level, where they can learn more aspects of the business. It also wouldn’t hurt to have a strong background in chemistry, biology, and microbiology; to combine a food sciences degree with a fermentation sciences degree from a school such as UC Davis; and to learn to make beer at home.

As far as Larson is concerned, such work is worth the result: in his case, a great job doing something he loves.

"You meet a lot of great people in this business," he says. "And we love that we get to do something that we enjoy and that we can also share with others."*

Courting the absurd

It didn’t matter how soon paramedics arrived. Kevin Noah, a 42-year-old carpenter with three sons, had no chance. The accidental 50-foot plunge from his perch on the Golden Gate Bridge killed him immediately.

Noah’s dizzyingly high station was a mere cross section of rebar — the slender iron braids that are often seen protruding from construction sites and provide a structure with skeletal support — inside an anchorage house located on a landbound portion of the bridge’s southern end.

Moments before on that August 2002 morning, Noah had been performing his normal duties, receiving planks of wood from another worker for use in forming a temporary frame to contain a wall of fresh concrete. The bridge was a year into phase two of its multimillion-dollar retrofit, which today is nearly complete.

Suddenly, the clip on Noah’s brace slid off the edge of an open-ended piece of rebar, and a nearby worker looked up just in time to see Noah’s body collide with the extended boom of an industrial cherry picker before falling the rest of the way to the ground, according to an account in public workplace-safety records.

In February 2003, Cal/OSHA, of California’s Division of Occupational Safety and Health, concluded its investigation and penalized the retrofit’s prime contractor, joint venture Shimmick-Obayashi, for, among other things, allegedly failing to properly rig Noah’s fall protection and not providing workers with scaffolding to stand on in construction areas where the footing was less than 20 inches wide. Fines for the violations — three of them designated by the agency as serious — totaled more than $26,000.

But Shimmick-Obayashi wouldn’t pay a dime.

The outfit immediately turned to the Cal/OSHA Appeals Board, and since such cases are backlogged statewide, the matter didn’t reach an administrative judge until this year, when attorneys for Shimmick-Obayashi presented a peculiar defense. Cal/OSHA, they argued, sent the company citations through the mail that failed to list the full legal name of the company: the mailings were addressed to Shimmick-Obayashi instead of Shimmick Construction Company, Inc./Obayashi Corporation, Joint Venture.

The misstatement was akin to a cop failing to note "Esq." or "Jr." on a parking ticket. Cal/OSHA pleaded with the judge, Barbara Steinhardt-Carter, that "it is against civil law, board precedent, and public policy to dismiss this matter based on a minor technical fault that misled no one and caused no prejudice."

Steinhardt-Carter, however, bought the company’s claim and ruled earlier this year that Shimmick-Obayashi was liable for none of the fines, even though Cal/OSHA got the name it used from the company’s business cards.

Throughout a three-year period during which the parties exchanged memos, motions, and discovery material, the contractor’s lawyers never mentioned a problem with the original citations, Cal/OSHA spokesperson Dean Fryer told the Guardian, and variations of the name Shimmick-Obayashi appear on several court documents. The move was a last-minute Hail Mary by a cunning industry lawyer who represents several major players in the business. And it worked.

"The outcome of this case is really surprising and disappointing to our staff," Fryer said. "They went through a long and thorough investigative process, and their work is now basically disposed of."

That Shimmick-Obayashi attorney, Robert D. Peterson, knows more about workplace-safety laws than most. He literally wrote the Cal/OSHA handbook commonly used by employers today and served as chief counsel to the appeals board until 1978. That’s when he established his own law firm and began representing large-scale employers in occupational-safety and workers’ compensation proceedings.

"The bottom line is, if the division has a responsibility to identify correctly the employer that it’s alleging created a violation of a safety order [and] it doesn’t do that, then the citation won’t stand the light of day," Peterson told the Guardian. "Apparently, they didn’t do that. It’s a pretty simple thing to do."

Mammoth civil engineering concerns commonly form temporary partnerships, as several have done to bid on the half-dozen Bay Area bridge retrofit projects initiated by the state at a cost of billions of dollars since the Loma Prieta earthquake rattled the coastline in 1989.

Shimmick-Obayashi won its $122 million phase two contract in 2001 to replace the Golden Gate Bridge’s steel support towers and reinforce its pylons. That came after phase one more than doubled in cost to $71 million by the time it was completed that year under another contractor. All told, Shimmick-Obayashi will earn more than $150 million following a series of change orders, a spokesperson for the bridge agency told us.

The joint venture’s initial bid beat out those of four other firms, including the politically well-connected Tutor-Saliba Corp., which later earned $760 million in a partnership with two other companies to reinforce the Richmond–<\d>San Rafael Bridge. We’ve previously reported on the dozens of injuries and the three deaths that have occurred during that project (see "Lessons from the Bridge," 11/14/06).

Obayashi on its own has had a string of run-ins with Cal/OSHA in recent years. Last March regulators hit its local housing construction subsidiary with $27,000 in fines for allegedly failing to maintain proper railings at a site in downtown Oakland, according to a federal Occupational Safety and Health Administration database analysis. The company is currently fighting those penalties. In February it was fined $6,400 for an alleged lack of railings at a project in the Bayview. Overall, the company has $60,475 in statewide open Cal/OSHA penalty cases dating to 2005.

Shimmick’s cases are few since 2000, but in the middle of last year, Cal/OSHA issued the firm two serious citations totaling $36,000 in fines after an aerial lift carrying an ironworker reportedly fell off a 34-inch light-rail platform during construction of the Muni’s T Third line, "ejecting the employee into the fast lane of traffic." The 52-year-old man was taken to San Francisco General Hospital with a serious skull fracture. A safety director for Shimmick, Ike Riser, argued that despite the accident, Shimmick has one of the best safety programs in the state.

The incentive to keep even small settlements from blemishing a safety record is huge for contractors because they can lead to the escalation of insurance rates and make bidders less competitive. Cal/OSHA’s Fryer said that while Shimmick and Obayashi have faced serious recent incidents, together they have had relatively few problems on the Golden Gate Bridge.

What can I tell you? There is a huge market for porn featuring shemales, young, pretty pre-op or nonop transsexuals, a.k.a. "chicks with dicks." The answer to what I assume is your underlying question, meanwhile, does not exist, and I can prove it. I was feeling kind of bored with my own standard answer to similar questions and, in a fit of ennui, entered "he looks at shemale porn" into a search box. I got eleventy million porn sites and this, from the archives of the late and, I guess, occasionally lamented Google Answers:

Q: Why would a man in a committed, loving, sexual relationship use shemale and transgender porn?

A: There is no answer at this time.

So there you have it.

More seriously, there really can’t be an explanation for what all those straight guys are getting out of all that shemale porn — if you asked them, you’d get various answers, including "I dunno, I just like it." A lot of "I dunno, I just like it." The most obvious and, to the wives and girlfriends looking on anxiously from the sidelines, most troubling answer is, of course, "They’re gay, gay, gay," but honestly, it isn’t likely. Gay men tend to be attracted to men — sometimes little, slim, smooth-bodied men, sometimes big, hairy, muscle-bulgy men, but men just the same. There are, of course, exceptions — there are always exceptions — but most of the audience for this stuff (and the vast majority of customers for the vast selection of shemale-type sex workers out there) are as straight as you are. Some are obviously penis curious but, not being gay, would not be turned on by porn featuring big muscley guys named Rod or Steel or Steel Rod. Some just like stuff that feels forbidden or dirty. Some, I suppose, may be fantasizing that they are the shemale (a term, by the way, best reserved for sex workers and porn models, while just-regular-folks male-to-female transsexuals generally think of themselves as trans women of various op or nonop sorts).

Actually, I know an even better way to piss off a well-educated, politically aware trans person than to call her a shemale: use the word autogynephilia. Then duck. No, don’t call her a duck — I mean duck and cover, since she will want to punch your throat out.

Autogynephila is part of an alternative (in this case, alternative to the correct one, if you ask me) model of transsexuality in which male-to-female transsexuals are not women of any sort but merely gender dysphoric males or, if postop, men without penises, and in which those trans women who aren’t attracted to men (lots, in my experience) are not lesbians, bisexuals, or asexuals but autogynephiles, men who are turned on by the image of themselves as women. In other words, they spent masses of money, went through surgeries, changed their entire lives, and often lost family members, spouses, and jobs, all for a sexual thrill. This model seems too stupid to have gained any currency at all outside the crabbed little hearts of its three or four well-known proponents, but apparently you can still find it in the Diagnostic and Statistical Manual of Mental Disorders DSM-IV-TR, the most up-to-date version of the standard reference your psychiatrist or therapist uses to figure out what the hell is wrong with you.

So what does this have to do with your question? Oh, nothing much, I just thought it was an interesting — if slightly nongermane — footnote, and if you don’t like interesting if slightly nongermane footnotes, you probably don’t read this column.

I think your man who loves women and moms and fluffy lavender bunnies (I’m sorry, but you inadvertently made him sound a bit like, oh, remember that unaccountably heterosexual Peter Pan guy, the one with the Web site and the large collection of jerkins who’s forever looking for his Tinkerbell? That guy) has a fetish, plain and simple. The Web exists to give such people an outlet, and I may be naive, but I truly believe that a guy who loves you and is happy with you can easily satisfy his yen for exotica in the privacy of his home office and need never stray. You’ve already asked him about that. He’s already answered. I’d be inclined to shrug and believe him.
