Memorial concert follows DA’s decision not to charge driver who killed cyclist

In the wake of yesterday’s decision by the District Attorney’s Office not to bring criminal charges against the driver who killed 24-year-old Amélie Le Moullac as she cycled in the Folsom Street bike lanes on her way to work last August, her family will be holding a benefit concert this Friday (May 16) for Amélie’s Angels, a charity created in her name to benefit needy schoolchildren in Haiti.

The concert by Amelie’s mother, organist Jessie Jewitt, and other Bay Area musicians starts at 7:30pm in St. Mark’s Episcopal Church in Palo Alto, featuring the Palo Alto Philharmonic and Conducter Geoffrey Pope. Amélie’s friend and co-worker Steve Lynch, who told us the event will be both a memorial and a fundraiser, said he was disappointed by the DA’s office decision not to bring charges in the case.

“I personally find this to be very upsetting, particularly given the way her investigation was handled, but the main reason I wanted to write you was to see if you would be interested in mentioning the benefit concert. It’s something that we’re trying to do to get her family some closure,” Lynch told us.

As KQED reported yesterday, the DA’s Office decided there was insufficicient evidence to bring an involuntary manslaughter charge against delivery truck driver Gilberto Alcantar, who turned right at Sixth Street across Le Moullac’s path, killing her. The San Francisco Police Department had recommended criminal charges after initially conducting only a cursory investigation, an insult that was compounded by Sgt. Richard Ernst showing up and making insensitive, victim-blaming comments at a memorial event by cyclists at the scene of Le Moullac’s death. Afterward, bike activists asked nearby businesses if they has surveillance video of the accident, finding video that police had neglected to seek that led investigators to conclude that Alcantar didn’t have the right-of-way when he ran over Le Moullac.

The Board of Supervisors held hearings on how the SFPD conducts such investigations, and Police Chief Greg Suhr later apologized for Ernst’s comments and the faulty investigation and pledged to conduct more thorough investigations when motorists kill cyclists, including looking at the three other similar fatalities last year. Alcantar was never even given a traffic citation in the deadly accident, but Le Moullac’s family has filed a civil wrongful death lawsuit against Alcantar and the company he was driving for at the time, Daylight Foods.

Since the accident, the San Francisco Municipal Transportation Agency has created new bike lanes and other markings on Folsom Street to more clearly delineate how bikes and cars should merge as they approach intersections so as to avoid the illegal “right hook” turns that are so dangerous to cyclists.

In a public statement announcing Amélie’s Angels and the benefit concert, Jewitt said, “Many people have asked me whether I was going to set up some type of fund or activity to improve the safety of SF streets for bicyclists. Although great improvements need to be made in this area, I leave it to advocates such as the Bicycle Coalition and other concerned individuals to petition for these changes. Amélie was not a cyclist. She was simply a young woman who thought that cycling to work would help the environment and would be a good form of exercise. In the days following her death, I felt her love so intensely, I knew I had to channel it into some activity that would directly enhance the lives of others.”

San Francisco attorney Joseph Tobener has been doing tenants rights work in San Francisco for more than a decade, starting his own practice in 2002, where he currently employs three other attorneys and two paralegals. Another pair of attorneys who used to work there recently spun off their own practice.

In the last year of so that Tobener came onto our radar with the work he’s done fighting evictions and displacement, including representing an organization leading those fights, San Francisco Tenants Union, and paying attorney to do one day a week of volunteer work for SFTA, the San Francisco Housing Rights Committee, and other organizations. 

“We’re busier than we’ve ever been. We get about 60 calls a week and we always give free consultations,” Tobener told us.

Among those calls have been tenants displaced so landlords can use Airbnb to rent rooms to tourists and get around local rent control laws and other tenants protections, an increasingly high-profile issue that Tobener has helped elevate through stories in the San Francisco Chronicle and Bay Guardian (see “Residents vs. tourists,” Feb. 4).

“I feel like we’ve made some progress in getting people aware of this issue,” he told us.

Under contract with SFTU, Tobener has gone on to sue seven more landlords who have evicted longtime tenants in favor of short-term tourist rentals that are illegal under city law, and he says that he’s preparing to file many more such cases (see “Lawsuits target Airbnb rentals,” April 29).

After also scoring a big recent victory by getting the city to finally fix elevators in public housing projects, Tobener has made a thriving small business out of defending the longtime residents from displacement.

Panchita’s Pupuseria

In the gentrifying heart of the Inner Mission District — near the corner of 16th and Valencia streets, where longtime bookstores, markets, bars, and restaurants have all been forced out by rising rents in the last year or so — a simple Salvadorean restaurant has continued to thrive by serving one dish, pupusas, to customers old and new.

Panchita’s Pupuseria is a wonderfully unassuming little restaurant that spills out of its own doors on busy weekend nights, with its family members joining the street food vendors on the sidewalk flipping these tasty treats, as they’ve been doing in a series of Mission locations over the last 24 years.

“My grandma and mom started it there with a bunch of my uncles,” Doris Vargas tells us of the original location on 17th Street that has since closed. She and her family don’t mind the challenging evolution of the Mission, with its influx of high-paid tech workers. “It has expanded our customer base. My mom loves that pupusas have been exposed to a larger crowd.”

The pancake-like pupusas are served right off the grill with hot sauce and curtido, a slaw-like mix of cabbage, carrots, and spices soaked (the word actually mean “soaked” in Spanish) in a vinegar that Vargas’ namesake mother makes herself, infused with pineapple, something she learned before emigrating from El Salvador at the age of 25.

Simple, delicious, family-run — and a survivor appreciated by us and the large crowds of newbies that have begun to discover it.

Hidden in a strange, inward-facing compound at 18th and Folsom streets that is filled with small art galleries, hair salons, and oddly themed storefronts, Pirate Salon has always been groovy spot to get a killer hairdo with a rogue flair, particularly by the Barcelona-born-and-trained queen of color and style Ana Rivero Rossi for the last four years.

While Pirate Salon is still a small business worth recognizing and visiting, Rivero Rossi’s brand new salon on Valencia Street between 24th and 25th, HeartZilla, is really something special. Along with her boyfriend Todd Hanson, also a fellow artist, Rivero Rossi has scoured the Bay Area for groovy vintage chairs, fixtures, and other funky decor that ooze the same unique flair (for example, we dig the colorfully drip-painted walls) that she brings to her clients’ hair.

“It is important that each hair style that I do is custom designed, with love, to the desires and idiosyncrasies of the client. I collaborate with every client to create a look that allows each person to feel uniquely themselves, their inside worlds expressed outwardly, with freshness and finesse,” she said, describing the concept behind her new salon at “a love-hair monster.”

As a visual and conceptual artist (anariverorossi.blogspot.com), Rivero Rossi (who is my stylist) has created some interesting street art pieces, including Aqui Love, a series of artistic custom hearts connected by shoestrings hanging from overhead electrical wires around the city — a play off of the hanging pairs of shoes that are the stuff of urban legends.

Now, Rivero Rossi is pouring her own heart into HeartZilla — which is just now getting off the ground in this high-profile location, and she’s still in the process of selecting the right stylists to fill out her other chairs — so we thought this newcomer to Valencia Street deserves some love from us and from you.

Bike to Work Day marred by another Wiggle police sting UPDATED

City officials and the San Francisco Bicycle Coalition hailed yesterday’s Bike to Work Day as a success, with the official SFMTA count finding 76 percent of vehicles along Market Street during the morning commute were bikes. But a pair of motorcycle cops ticketing cyclists that afternoon on the Wiggle put a damper on the celebration.

As we reported in this week’s paper, cycling has come to enjoy almost universal support in City Hall, at least in terms of political rhetoric, although the Mayor’s Office and SFMTA have committed only a small fraction of the funding needed to meet official city goals for increasing ridership. And yesterday’s bike sting on the Wiggle, a key east-west bike corridor in Lower Haight, felt like a slap in the face to the SFBC.

Since another series of police stings targetting cyclists on the Wiggle last fall, SFBC Executive Director Leah Shahum has been working closely with the San Francisco Police Department on its goal of focusing traffic enforcement resources on intersections with the most collisions, none of which include the Wiggle (the SFPD’s Focus on the Five initiative pledges traffic enforcement resources to the five most dangerous intersections in each police district and the five most dangerous traffic violations).

On Wednesday night, Shahum was even at the Police Commission hearing discussing the issue, and she says that Police Chief Greg Suhr and other top brass in the department have offered their assurances that such arbitrary stings on the Wiggle weren’t a good use of SFPD resources.

After recent hearings on how SFPD officers have refused to give citations to motorists who hit cyclists, Suhr and the department have also pledged to do so. But Shahum said she also heard from a cyclist on Bike to Work Day who was the victim of a hit-and-run by an impatient, road-raging motorist on 18th Street, and he told her that police refused to take a report even though he took down the license plate number.

Shahum said she’s disheartened by that story and those of the half-dozen cyclists she heard from who were ticketed on the Wiggle for not coming to a complete stop at a stop sign on the Wiggle.    

“I’m not confident the commitments from the chief and the commission are making it down to the officers. They are still pursuing very outdated traffic enforcement policies,” Shahum told us.

Shahum said she spoke to Capt. Greg Corrales, whose Park Station precinct includes the Wiggle, and Cmndr. Mikail Ali, who heads traffic enforcement, and both said they had no knowledge of any enforcement stings on the Wiggle. We left a message for SFPD spokesperson Albie Esparza, and we’ll update this post if and when we hear back. [UPDATE 5/12: Esparza just told us these citywide traffic enforcement officers were there based on citizen complaints about people running stop signs, but that the timing on BTWD wasn’t intentional: “It was a random thing they happened to be there that day.” He also noted that just 1 percent of traffic citations from April went to cyclists, and 93 percent to motorists, but he said officers can’t ignore traffic violations. “We cannot say as an agency do not cite pedestrians, do not cite bicyclists, that would be selective enforcement,” he said, while also agreeing that if officers that day on the Wiggle ignored motorist violations to focus on cyclists, that would also be selective enforcement.”] 

One of the cyclists ticketed on the Wiggle yesterday wrote this account to Shahum: “I suspect you will be hearing from a lot of cyclists in the next few days regarding the 2 cops who decided to hang out at Waller and Steiner Sts. yesterday to nail riders ‘running the stop sign.’ I was there at 4:51pm yesterday and I approached that intersection as I always do everyday braked with my right hand and signaled with my left arm to make that left turn onto Waller. I know for a fact I stopped as there was a car opposite me heading south on Steiner and I had to make sure which direction it might go. Once I made my left turn, there to greet me was a man in blue telling me to stop and present my driver’s license to him. He said that I failed to stop and I quote ‘your pedals were still moving at the stop sign.’… So,  a great 20th anniversary of bike to work day turned out to be a real downer for myself and I would guess for dozens more of riders. What a scheme to do this on a bike to work day with so many more riders out there.”

At the Bike to Work Day rally outside City Hall yesterday morning, where a broad cross-section of local political leaders and city officials spoke after riding their bikes to the event, Chief Suhr talked about the importance of making the streets safer for pedestrians and cyclists: “We are all in this together. Under the leadership of the mayor and the supervisors, all the department heads, we are committed to Vision Zero that in 10 years there are no fatalities in San Francisco.” 

Mayor Lee, who also rode to work, said: “I was proud to celebrate the 20th anniversary of Bike to Work Day by riding this morning from my neighborhood, Glen Park, accompanied by a growing number of bike commuters, including families, who are taking advantage of the benefits of a fun, healthy, affordable way to move around our City. With innovative bikeways like the new contraflow bike lane on lower Polk Street that connects Market Street to the Tenderloin and City Hall, we continue to improve and enhance our City’s bike network to connect our residents, neighborhoods, and businesses. But in order to do even more to make our streets safe, we must invest in our aging transportation infrastructure.” 

Ownership in Guardian’s parent company may shift

Greetings, Guardianistas. Almost a year ago, when we went through a management struggle here the newspaper, I promised to let readers know if we encountered any threats to our editorial independence from our San Francisco Print Media Co. owners.

Frankly, we haven’t. We’re still calling events as we see them, bringing you the best emerging artists, and making endorsements from the same independently progressive perspective that we’ve been operating from since we were founded in 1966.

Principal owner Todd Vogt has kept his word and let us handle editorial content while he helps improve our revenues and grow the paper. Both have been on the upswing in recent months, and we’re grateful for his role in keeping the Guardian alive and thriving.

But as our colleagues down the hall reported last night, Vogt may be on his way out. This week, he informed the staff of the three San Francisco Print Media newspapers — the Bay Guardian, San Francisco Examiner, and SF Weekly — that he will be parting ways with his partners at Black Press Ltd., which also owns Oahu Press, Inc., by the end of the month.

Vogt has been talking to potential investment partners around San Francisco about exercising his option to take full ownership control of San Francisco Print Media Co. in the next couple weeks, but he said that he considers it unlikely given the high cost of buying out his partners.

Representatives from Black Press and Oahu Press were in the office yesterday and they told us they will be conducting a search for a new president of the company over the next few months, and they don’t expect to make any major changes in the operations of the Guardian or the other two papers before then.

Don Kendall with Black Press, who will be assessing the operations of all three papers during the search for a new president, called the papers “editorially solid.” A long-planned move by the three papers into new office space — into the top floor of the Westfield Mall, in a former SFSU Downtown Campus space — will also proceed as scheduled next month.

Spirits here at the Guardian are strong, we appreciate the role that Vogt has played in helping the Guardian mount a comeback after some tough financial times, and we’re hopeful that the new ownership team will appreciate the Guardian’s history and role it plays in the city — and that it will see us through our 50th anniversary and beyond.

When the first Bike to Work Day was held in San Francisco 20 years ago, cyclists had little support in City Hall. But on May 8, almost every one of the city’s top political leaders will take part in Bike to Work Day, pledging their support to an increasingly popular and important transportation option.

In fact, Bike to Work Day has become such an anticipated event in San Francisco that city officials and cycling advocates in recent years have used it as the deadline to unveil the latest high-profile bike project to demonstrate the city’s commitment to cycling.

This year, it’s the new contraflow bike lanes on lower Polk Street, an important connection from Market Street to City Hall that helps cyclists avoid dangerous, car-centric Van Ness Avenue or Larkin Street — without having to illegally cut up the one-way section of Polk.

When that $2.5 million bike and pedestrian project — with its attractive landscaping, pedestrian bulb-outs, pretty green lanes, and trio of special bike-only signal lights — was officially opened on May 2, bike activists kept circling the new lanes as if they were doing victory laps.

“I cannot think of a better way to kick off Bike Month in the Bay Area and the 20th anniversary of Bike to Work Day, coming up May 8, than to celebrate what I think is the most beautiful, functional, well-designed, and what is probably going to be the best used piece of bike infrastructure in our city,” San Francisco Bicycle Coalition Director Leah Shahum said at the ribbon-cutting ceremony.

She and the others who spoke at the event praised the city officials who moved quickly to complete this project, calling it a testament to the growing political will to make streets safer and more welcoming for cyclists.

“I will be honest, we put a lot of pressure on to get this done by Bike to Work Day,” Shahum said. “We really wanted to make sure you all and the folks throughout this city could, this year, for the first time in San Francisco’s history, make a safe and comfortable and direct link from Market Street…to City Hall.”

Building high-profile, separated cycletracks to the steps of City Hall seems to symbolically mark the arrival of cyclists into the political mainstream.

 

TIMES HAVE CHANGED

Twenty years ago, California Bicycle Coalition Director Dave Snyder was the head of SFBC, and he was able to persuade only one member of the Board of Supervisors to participate in that first Bike to Work Day.

“I should give a shout-out to Tom Ammiano because he was the first supervisor to care enough to ride on Bike to Work Day, back when the Board of Supervisors didn’t really care about cycling,” Snyder told us. “These days, it’s not uncommon for supervisors to ride for transportation, but back then none did.”

Shahum remembers it as well, back before the SFBC was one of the city’s largest member-based political advocacy organizations.

“Twenty years ago, Bike to Work Day was a fun but sort of lonely event,” Shahum told us, noting how the number of cyclists on the road has exploded in recent years. “Riding on a regular Thursday during rush hour feels like Bike to Work Day used to feel 20 years ago.”

But both Snyder and Shahum said the universal statements of support for cycling that emanate from City Hall these days are only half the battle.

“It’s a good idea to promote bicycling as a mainstream activity, and we won that battle,” Snyder said. “Now, we have to get them to put their money where their mouth is.”

With cycling projects receiving less than 1 percent of the city’s transportation funding, and city officials so far unwilling to pay for the projects that would allow the city to meet its official goal of 20 percent of all vehicle trips being by bike by the year 2020, Snyder said, “We haven’t accomplished that second goal yet.”

“We hear them all talk about investing money in bike infrastructure,” Shahum told us, “but now the decision makers need to do it.”

A report released in December by the Budget and Legislative Analyst’s Office shows that San Francisco spends less per capita on bike infrastructure, at just over $9 annually, than other bike-friendly US cities such as Portland, Minneapolis, and Seattle. And it found the city would need to spend about $580 million to reach its official goal of 20 percent bike mode-share by 2020.

Even meeting the SFMTA’s more moderate Strategic Plan Scenario — which aims to reach 8-10 percent mode-share by 2018 by creating 12 miles of new bike lanes and upgrading 50 existing miles and 50 intersections — would require $191 million. That’s $142 million more than the SFMTA now has budgeted for the work.

 

FUNDING PITCH

At the May 2 event on Polk Street, city officials used the new project to call on voters to approve a pair of transportation funding measure proposed by Mayor Ed Lee for the November ballot — an increase in the vehicle license fee and a $500 million general obligation bond — which the Board of Supervisors will consider later this month.

“Do you guys like what you see here?” SFMTA Director Ed Reiskin told the crowd, eliciting a rousing response. “Would you like to see more of this kind of work all over San Francisco?”

Then Reiskin connected that goal to the fall ballot measures, the lion’s share of which will go to Muni improvements.

“With the funds we have, there’s only so much of this we can do and we know the need is so great to make biking and walking a safer and more attractive means of getting around the city. If we want to do more of this, we’re going to need more support in November,” Reiskin said.

The city has make significant progress on new bike infrastructure in recent years, after a legal challenge of the city’s Bicycle Plan stalled projects for four years. Ben Jose, a spokesperson for the SFMTA, told us the Polk project is the 52nd of 60 bike improvement projects from the Bike Plan.

“And those that are left are signature projects like this one,” Jose said at the event, referring to high-profile bike lanes along Bayshore and Masonic boulevards, on upper Polk Street, and along Second Street that are among the bike projects now in the pipeline. But the city hasn’t yet devoted the resources to completing the city’s bike network.

“We want to do more projects like this with money from the fall ballot measure,” Rachel Gordon, a spokesperson for the Department of Public Works, told us. “We don’t have enough money in our general fund to do these projects and we hear loud and clear the streets need to be safer for bicyclists and pedestrians.”

 

LITTLE PROJECT, BIG GAIN

The new bikes lanes on Polk are only a few blocks, but it is those kinds of small but critical connections that determine whether cycling in the city is safe or scary.

“I want to know that I can bike safety going north and south on Polk Street, which is why I strongly, strongly support our protected bike lanes on Polk Street, so this is super exciting. As a beginning cyclist, these are the kinds of routes I need to see to get out of my car and onto a bike, so I’m really excited this is the direction our city is moving in,” Sup. Jane Kim said at the event.

Reiskin noted how awkward and unsafe it has been to get from Market Street to City Hall or up Polk Street: “Physically, it’s a pretty small project, but it’s so critically important for those of us who do get around by bike.”

Cyclist Shannon Dodge also spoke at the event, describing her previously awkward commute to work from the Mission District to Russian Hill: “It might look like a tiny stretch of bike lanes to most people, but to me and lots of other people it will make a huge difference. It means we can turn now directly onto Polk Street and we can do it safely.”

She also compared cycling in San Francisco today to the days just before Bike to Work Day began.

“Twenty-one years ago this month, I moved to San Francisco from the East Coast. I came in a van with three friends, so I didn’t bring a lot of possessions. But I did bring my bike and I’ve been biking in San Francisco ever since,” Dodge said.

Back then, in her younger days, she didn’t mind battling for space on the streets of San Francisco.

“When I first moved here, just out of college, safety was not that important to me. I kind of enjoyed the adrenaline rush of being out on a bike in traffic,” she said. “But now I’m a mom. I have a 3-year-old son, and my husband and I bike our son to and from his preschool everyday. And on the weekends we explore the city, which usually means he’s on one of our two bikes. Pretty soon, he’ll be riding his own bike out on San Francisco streets. So safety is incredibly important to me, as it is to all families.”

Illegal anti-Campos flyers the subject of an ethics complaint

Several San Francisco neighborhoods over the last week have been targeted with illegal campaign flyers against Assembly candidate David Campos — breaking both state election laws requiring the group and its funding source to be identified and local laws against placing political flyers on utility poles and other surfaces.

Former Ethics Commission Eileen Hansen this week filed a complaint about the guerilla campaigning with the California Fair Political Practices Commission, which has jurisdiction over state races.

“I am asking for the intervention of your office into what appears to be a blatant and arrogant violation of campaign finance reporting and disclosure laws in California’s 17th Assembly District Primary Election,” Hansen wrote in the April 30 letter. “As you well know, the political climate in San Francisco is quite sensitive, and nerves are raw. If this violation is allowed to continue, it will have a chilling effect on the entire election and further alienate voters, and potential voters.”

The race between Campos and David Chiu has indeed gotten more heated in recent weeks, but Chiu campaign spokesperson Nicole Derse denies that the campaign has any knowledge or involvement with the illegal campaigning: “We think everyone in this race should be transparent.”

In her letter, Hansen casts doubt on the Chiu campaign’s claims of innocence: “The wide distribution, professional design, and overnight appearance in distant locations strongly suggest that these flyers have been produced and distributed by a funded political organization aligned with Assembly candidate David Chiu, whose aim is to attack and discredit Chiu’s opponent David Campos.”

And she even identifies a leading suspect in this illegal campaigning: Enrique Pearce and his Left Coast Communications firm, which has a history of dirty tricks campaigning on behalf of Mayor Ed Lee and other establishment politicians. Hansen notes that the flyers appeared right after the registration of a new campaign committee, San Franciscans for Effective Government to Support David Chiu. Although the group hasn’t reported any fundraising yet, its contact phone number goes to Left Coast Communications and Pearce, who hasn’t yet returned our calls on the issue. [UPDATE: Pearce called back and categorically denied any involvement with the illegal flyers, and he blasted Hansen for speading what you called “scurrilous lies” with no foundation, saying he has called her directly and expects an apology.]

This campaign stunt in reminiscent of an “independent expenditure” effort in the District 6 supervisorial race in 2010, when Pearce was connected to a mailer supporting Sup. Jane Kim that was funded partially by Willie Brown, again because the supposedly independent group listed his phone number even though he was worked directly for Kim.

The anti-Campos mailers include some nasty and misleading charges, labeling Campos “City Hall’s Hypocrite” by falsely claiming Campos ignored rising evictions until he decided to run for the Assembly and that he was concerned about Google buses but wanted to charge them less than $1 per stop. A third flyer claims Campos “lets wifebeater sheriff keep his job” for his vote against removing Sheriff Ross Mirkarimi from office for official misconduct.

“This is a secretly funded shadow organization aligned with David Chiu, committing a desperate move that is as illegal and it is false in its claims,” Campos told us, saying he hopes the FPPC is able to stop and punish those involved.

Happy May Day, comrades, and what a fine May day it is even if the urgent mayday spirit on this International Workers Day doesn’t seem as strong as some recent years past in the Bay Area.

While Russia seems to be rediscovering its previous practice of massive May Day marches marked by anti-Western propaganda, spurred on by renewed nationalism from the standoff in Ukraine, May Day has never been very big in the US.

The holiday celebrated throughout the world with workers showing their strength and demanding their fair share of our collective wealth marks the anniversary of a labor demonstration that turned violent and triggered a harsh crackdown in Chicago in 1886. While the socialists of the Second International adopted the May Day holiday in 1889, the American holiday of Labor Day was adopted as a bland alternative meant to take the radical edge off of workers movements.

But many leftists in the US retained an affinity for May Day, and it was infused with a renewed spirit and radical energy by supporters of immigration reform and an end to deportations that divide up families, with massive marches in major US cities in 2006 catching the media and political establishment off-guard.

 Then, two years ago, fresh off of the Occupy Wall Street (and Occupy San Francisco, Occupy Oakland, etc.), some young anarchists rampaged through the Mission District, breaking windows, spray painting luxury cars, attacking a police station, and generally targeting what they saw as the forces of wealth and gentrification, albeit in a misguided and widely condemned way.

Today’s big May Day march in San Francisco starts at the 24th Street BART Plaza, again strongly emphasizing the need for immigration reform, but also marrying that cause with the anti-displacement and anti-eviction activism that are roiling San Francisco these days. [The poster for the event even features a photo of a recent Google bus blockade CORRECTION: The photo is actually of immigration activists blocking a deportation bus.]

Meanwhile, in the East Bay, the main May Day march begins at 3:30pm at the Fruitvale BART Street, also with a focus on social justice and immigration reform. So get on out there, comrades, you have nothing to lose but your chains.  

New coalition opposes Chiu’s Airbnb legislation UPDATED

An unlikely coalition has formed to oppose legislation sponsored by Board of Supervisors President David Chiu that would legalize and regulate short-term apartment rentals facilitated by Airbnb and other online companies, which are now illegal in San Francisco.

[UPDATE: Some of those same opponents are also now threatening to place a rival measure on the fall ballot, the San Francisco Chronicle just reported. It reportedly shares some aspects with the Chiu legislation, such as a registration system, but it limits rentals to only commercial areas and includes rewards for those who turn in violators to the authorities].

The coalition includes landlord and tenant activists, as well as organized labor and neighborhood groups. It will square off against Airbnb and its hosts, which have pledged to lobby against limits created by the Chiu legislation — all of which could elevate this to the biggest fight of the summer at City Hall. Tomorrow [Tues/28], the coalition of opponents will rally outside City Hall at 10am, while Airbnb supporter will hold a “Speak Up for Home Sharing” rally at 12:30pm.

As we’ve been reporting, it took Chiu more than a year of negotiations with Airbnb, the San Francisco Tenants Union, affected city agencies, and other interested parties to arrive at legislation that requires hosts to register with the city, finally pay the city’s transient occupany tax, and limits stays to 90 nights per year.

But after more than two years of Airbnb’s defying city law and refusing to pay its taxes — scofflaw behavior tacitly supported by Mayor Ed Lee, who share a financial benefactor for the company in venture capitalist Ron Conway — several city constituencies pledged to oppose legislation that would now legalize its activities.

In particular, some longtime affordable housing and neighborhood activists say the legislation irresponsibly legalizes the conversion of residential apartments into tourist hotels throughout the city, creating neighborhood safety concerns and overturning decades of work to protect rent-controlled housing.

Meanwhile, Chiu’s opponent in the race for the Assembly District 17, David Campos, has been highlighting lobbying reports showing 61 contacts between representatives of Airbnb — including formers City Hall insiders David Owen and Alex Tourk — and Chiu’s office.

“Do you think tenant and neighborhood groups met with David Chiu 61 times?” Campos said during his endorsement interview with the Guardian last week, accusing Chiu of letting Airbnb write its own regulations without regard to neighborhood concerns.

Chiu didn’t immediately return our phone calls, but we’ll update this post if and when we hear back. [UPDATE: Chiu legislative aide Judson True just called and disputed how the legislation is being characterized by its opponents and rejecting calls to withdraw the legislation: “Everyone is entitled to a position on Sup. Chiu’s legislation, but we would hope they would engage in the legislative process and not just toss hand grenades. This is a serious policy issue that requires thoughtful dialogue and to simply call for the withdrawal of the legislation is irresponsible.”

True also said the legislation only legalized short term rentals “under very narrow circumstance and that legalization allows enforcement against the most egregious actors.” He also noted how Chiu has consistently opposed converting apartments to tourist uses and called for Airbnb to pay its taxes, calling the legislation a difficult balancing act: “We know that Airbnb has issues with the legislation. They didn’t write the legislation, period.”]

San Francisco — Organizations representing usually divergent interests ranging from tenants to landlords, and from hotel workers to the hospitality industry have joined forces with neighborhood and homeowner associations to oppose legislation introduced by Supervisor David Chiu to legalize the short term rentals of residential property throughout San Francisco.

“In the face of an unprecedented housing crisis, Supervisor Chiu’s legislation to legalize the short term rentals of residential property will only exacerbate the housing crisis. This practice is detrimental to our rent-controlled housing stock”, said Janan New, Executive Director of the San Francisco Apartment Association.

“Our studies have shown that with over 10,000 units of housing being rented out over Airbnb, HomeAway and other websites this practice is having a negative impact on hotel workers and San Francisco’s hospitality industry”, said Mike Casey, President of UNITE HERE Local 2.

“The proposed legislation would rezone the entire city from residential zoning to commercial zoning in one fell swoop. We hear complaints from almost every neighborhood about the detrimental effects of short term rentals on the quality of life of tenants and residents”, said John Bardis, former President of the Coalition for San Francisco Neighborhoods and former San Francisco Supervisor.

“Supervisors Chiu’s legislation would repeal hard won controls on Single Resident Occupancy housing, threatens current affordable housing provisions for over 30,000 permanently affordable units, would transform newly approved “in-law units” into high priced motel rooms and make “below market rate” units lifetime luxury hotels. It is the single biggest threat to affordable housing ever proposed by a San Francisco Supervisor” stated longtime affordable housing advocate Calvin Welch.

“Airbnb and other hosting platforms owe the City millions of dollars in unpaid hotel taxes. It is high time that the City collect these taxes which pay for the arts and vital city services and programs. The proposed legislation does not clearly hold Airbnb and similar organizations responsible for collecting and remitting the hotel tax”, said former Supervisor Aaron Peskin.

All of these organizations are calling for Supervisor Chiu to withdraw his legislation at a press conference on Tuesday April 29 on the steps of City Hall at 10:00 am.

Fires on Ocean Beach limited and studied by GGNRA, which considers ban

The National Parks Service is once again moving to limit and maybe even ban fires on Ocean Beach, replaying an episode from 2007 that was temporarily solved by volunteers and artistic new fire rings placed by the group Burners Without Borders, despite a lack of follow through by NPS’s Golden Gate National Recreation Area.

Citing complaints about burning toxic materials, leaving messes, and people drinking on the beach (gasp!), the GGNRA this week announced a summer pilot program that would include moving the curfew up from 10pm to 9pm, installing a dozen new fire rings, and improved public outreach and monitoring of the conditions on the beach.

“We [have] over the years seen a rising problem over safety and general breaking of park rules like broken bottles. And with incidents of assault and underage drinking, mostly occurring during the night, GGNRA Area Director Howard Levitt told the Guardian.

But Tom Price, who helped create the 2007 compromise, said GGNRA never kept its end of the bargain — such as installing more rings to supplement the half-dozen created by artists, or creating visible signage so visitors would know what the rules area — and now it’s acting in a rapid, unilateral, and unreasonable way to ban beach fires.

“They never did the outreach or educaation or put out more fire rings,” Price said, urging people to let GGNRA know they support allowing fires on Ocean Beach, one of just two spots within GGNRA jurisdication where they’re allowed (Muir Beach is the other). “The Parks Service has to be reasonable, and banning fires after 9pm in not reasonable.”

In announcing the change, the GGNRA seems to admit that it didn’t do the follow-ups it had committed to: “The intent was to evaluate the program in 2009 and make a long term decision for fires on the beach. However, due to staffing shortages the 2009 review did not occur until 2013. Since 2009, the program continued as it had been originally developed in 2007. Maintenance staff continued to clean the pits and the beach, removing pits that became hazardous or non-functional, and Park Rangers continued to educate visitors engaging in beach fires and to enforce the existing regulations.” 

GGNRA has set a short comment window for this new policy, from April 21 to May 16, before implementing the change starting Memorial Day Weekend. Then the agency says it will decide at the end of the summer how the situation is working out and whether it needs to resort to the outright ban that it had considered in 2007.

Meanwhile, in addition to trying to work cooperatively with the agency, Price said would also resist the unilateral new changes, saying the 9pm curfew is particulalry absurd: “I’m inviting all my friends down to Ocean Beach at 9pm on Memorial Day to have some s’mores.”

Piketty discusses Capital and inequality in San Francisco

French economist Thomas Piketty got a warm welcome in San Francisco last night [Tues/22] when nearly 200 people turned out to hear him discuss what is fast-becoming the defining book of this new Gilded Era of escalating disparities in wealth: Capital in the 21st Century.

“The book has been so popular that Harvard University Press has run out,” The Green Arcade owner Patrick Marks said in introducing Piketty at an event held across Market Street from the bookstore, in the McRoskey Mattress Company, in order to accommodate the large crowd.

Indeed, Capital has recently been lauded by a string of influential publications, ranging from The Nation through The New York Times to the Wall Street Journal, all acknowledging this as perhaps the most exhaustive study on wealth data ever collected — and a clear-eyed warning that capitalism isn’t the self-correcting system that its biggest boosters claim it is.

Piketty’s work shows how when the return on capital is greater than the annual growth rate of the overall economy, which is usually the case (except when interrupted temporarily by the major wars of the 20th Century, or the 90 percent tax rate on the highest US incomes after World War II), that dynamic consolidates wealth in ever-fewer hands, which is bad for the health of the economic system.

The only real cure, Piketty concludes, is a progressive global tax on wealth. Yet Piketty tries to avoid being too prescriptive, choosing to let his research speak for itself. “All I’m trying to do is present this book so everyone can make up his own mind,” Piketty told the gathering. In fact, he thinks the cure he outlines at the end of his book is less important than what comes before it: “You can disagree with everything in Part IV and still find interest in Parts I, II, and III.”

Piketty is critical of his economics profession for focusing too much on abstract theories and mathematical modeling while avoiding the real world calculations of how wealth is distributed and its implications, which he says should be the central question for economists.

He says wealth is more important than income to gauging how we live, which is why he has culled and analyzed most available gauges of global wealth distribution going back to the French Revolution of 1789. “The book is trying to shift the discussion from the study of income to the study of wealth,” he said.

That analyis is particularly illuminating for the United States, which is now experiencing one of the most rapid and extreme consolidations of wealth in history. “It is clear the rise of inequality in the US has been much more spectacular than in Europe,” he said.

Yet Piketty can’t bring himself to criticize capitalism itself, even as his work makes clear this inherent flaw in the system. Indeed, he writes critically of the “lazy rhetoric of anticapitalism” and declares in the book’s introduction, “I have no interest in denouncing inequality or capitalism per se.”

I asked Piketty about that point and about why he’s unwilling to support calls for a more fundamental transformation of the global economic system. He repeated points made in his book about coming of age during the fall of communism in 1989, feeling no sympathy for autocratic leftist regimes, and accepting private property as a basis for the economic system.

I pressed him with follow-up questions about how global warming and other externalities of capitalism seem to be call for new economic models, but he resisted going anywhere that might be seen as ideological. That didn’t play well with the San Francisco audience — indeed, about a dozen people came up to me afterward to compliment my line of questioning — but it has probably helped innoculate Piketty against criticisms that might undermine the impact of his work.

In fact, Capital in the 21st Century seems to destroy many of the faith-based economic fallacies that drive much of the political discourse in the US, from our persistent belief in trickle-down economics to the obsession with our national debt, which conservatives use to promote austerity measures that punish the poor.

Such austerity agendas don’t make sense to Piketty, who says they won’t work now any better than the did in 19th Century Great Britain, which funded its wars with public debt rather than higher taxes, thus devoting too much of the national income to paying interest to the wealthy bond holders.

“A progressive tax on public wealth is a better way to reduce public debt at a faster pace,” Piketty said in the same matter-of-fact style that he uses to apply data-driven analysis to controversial political realms. “I believe in progressive taxation of wealth, but that requires coordination among countries.”

Similarly, Piketty says he is not daunted by the political difficulties in implementing a global tax on wealth, which seems all but impossible to most political observers.

“I’m not terribly impress by people who say this can’t happen,” Piketty said of his proposed global tax on wealth, noting how the conventional thinking used to be that a progressive income tax, like the one adopted in the US in 1913, could never happen. “I am not as pessimistic as a lot of people seem to believe.”

Lawsuits go after SF landlords doing illegal short-term apartment rentals

The San Francisco City Attorney’s Office today filed a pair of lawsuits against local landlords who illegally rent out apartments on a short-term basis, units that had been cleared of tenants using the Ellis Act. Meanwhile, the San Francisco Tenants Unions has hired attorney Joseph Tobener to file more such lawsuits, and he is preparing to file at least seven lawsuits involving 20 units.

The lawsuits are the latest actions in a fast-moving crackdown on Airbnb and other online companies that facilitate short-term apartment rentals that violate city laws against converting apartments into de facto hotel rooms, including VRBO.com and Homeaway.com.

Board of Supervisors President David Chiu recently introduced legalization that would legalize, limit, and regulate such rentals, a measure that will be considered this summer. That legislation comes on the heels of Airbnb’s decision to stop stonewalling the city (and us at the Guardian, which has been raising these issues for the last two years) by agreeing to start paying the transient occupancy taxes it owes to the city for its transactions and creating new terms of service that acknowledge its business model may violate local laws in San Francisco and elsewhere.

As we’ve reported, City Attorney Dennis Herrera has been working with tenant groups and others on a legal action aimed at curtailing the growing practice of landlords using online rental services to skirt rent control laws and othet tenant protection, removing units from the permanent housing market while still renting them out at a profit.   

“In the midst of a housing crisis of historic proportions, illegal short-term rental conversions of our scarce residential housing stock risks becoming a major contributing factor,” Herrera said in a public statement. “The cases I’ve filed today target two egregious offenders. These defendants didn’t just flout state and local law to conduct their illegal businesses, they evicted disabled tenants in order to do so. Today’s cases are the first among several housing-related matters under investigation by my office, and we intend to crack down hard on unlawful conduct that’s exacerbating—and in many cases profiting from—San Francisco’s alarming lack of affordable housing.”

The lawsuits allege violations of the city’s Planning and Administrative codes, as well as the state’s Unfair Competition Law, targetting 3073-3075 Clay Street, owned by defendants Darren and Valerie Lee; and 734 and 790 Bay Street, which is owned or managed by defendants Lev, Tamara and Tatyana Yurovsky (founder of SRT Consultants).

Guardian calls to both parties were not immediately returned, but we’ll update this post if and when we hear back. Tobener tells the Guardian that the San Francisco Tenants Union hired him to discourage local landlords from removing units from the market.

“The San Francisco Tenants Union is just fed up with the loss of affordable housing,” Tobener told us. “It’s not about the money, it’s about getting these units back on the market.”

The San Francisco Apartment Conversion Ordinance prescribes penalties of $1,000 per day for units rented out for less than 30 days. That now applies to buildings with four or more units, although Chiu’s legislation would lower that to buildings with two or more units while legalizing such rentals and requiring host to register with the city and live in the units for at least 275 days per year, meaning rentals would be limited to 90 days per year.

Tobener’s lawsuits list 210 violations in the 20 units it targets, seeking fines totaling $210,000. But he emphasized that money is not the issue: “The San Francisco Tenants Union doesn’t care about the penalties, they just want to put the message out that we’re going after landlords who do this and we want those units returned to the market.”

It’s never been easy for progressives to mount a serious campaign for the California governor’s office. The high water mark was in 1934 when famous author/activist Upton Sinclair ran on his End Poverty In California platform and got nearly 38 percent of the vote despite being shut out by the major newspapers at the time.

That campaign was cited by both of this year’s leading leftist challengers to Gov. Jerry Brown — Green Party candidate Luis Rodriguez and Peace and Freedom Party candidate Cindy Sheehan — who say the goal of ending poverty is more important than ever, but who are also having a hard time getting media coverage for that message.

The latest Field Poll from April 9 shows Brown with a 40-point lead on his closest challenger, conservative Republican Tim Donnelly (57 to 17 percent, with 20 percent undecided). Republicans Andrew Blount and Neel Kashkari were at 3 and 2 percent, respectively, while Rodriguez and Sheehan are among the 11 also-rans who shared the support of 1 percent of the California electorate.

Perhaps that’s to be expected given that Brown is a Democrat who pulled the state back from the edge of the fiscal abyss largely by backing the Prop. 30 tax package in 2012, with most of the new revenue coming from increased income taxes on the rich. But to hear Rodriguez and Sheehan tell it, Brown is just another agent of the status quo at a time when the growing gap between rich and poor is the state’s most pressing problem.

“We have to put all our resources into ending poverty,” Rodriguez told us.

The campaigns that Rodriguez and Sheehan are running seem indicative of the state of progressive politics in California these days, with good work being done on individual issues by an array of groups, but little coordination among them or serious work on the kind of organizing and coalition-building needed to win statewide office.

There is still hope, particularly given California’s open primary system, where all Rodriguez or Sheehan need to do is beat the top Republican challenger in June in order to face Brown in a two-person race in November — an outcome that would definitely elevate their progressive message.

“One of our sayings is ‘second place wins the race,'” Sheehan told the Guardian.

But at this point, that seems unlikely, a longshot that points to the need for progressive-minded Californians to rebuild the movement and win over new generations of voters, particularly the young people disconnected from electoral politics and largely behind by the economic system.

 

REACHING VOTERS

When we asked Sheehan how her campaign was going, she replied, “It’s going.” When we pushed for a bit more, she told us, “It’s very, very grassroots and we’ve been trying to get the word out.”

And by “very, very grassroots,” Sheehan seems to mean that it’s not going very well, in terms of fundraising, volunteer support, media exposure, or any of the things a campaign needs to be successful. It’s been a disappointment for a woman who started her public political life as a media darling.

The year after Sheehan’s son Casey died fighting the Iraq War in 2004, she set up an encampment outside then-President George W. Bush’s ranch in Crawford, Texas, instantly becoming a high-profile anti-war activist just as public opinion was turning strongly against the war.

Sheehan parlayed that fame into international activism for peace and other progressive causes, writing a pair of autobiographical/political books, and mounting a primary challenge against then-Speaker of the House Nancy Pelosi in 2008, finishing in second place with about 16 percent of the vote. Sheehan was also the running mate of presidential candidate Roseanne Barr in 2012, although their Peace and Freedom Party ticket didn’t appear on the ballot in most states.

But these days, Sheehan has found it tougher to recapture the media spotlight she once enjoyed, causing her to sometimes bristle with frustration and a sense of entitlement, as she did with us at the Guardian for failing to help her amplify her message before now.

“Who came in 2nd against Pelosi? Who received well into ‘double digits?’ The campaign can’t get steam if ‘lefties’ put the same criteria as the [San Francisco] Chronicle for example for coverage. If I were truly in this for my ‘ego’ I would have quit a long time ago. You write, I campaign all over the world for the things I care about,” Sheehan wrote in a testy April 3 email exchange with me after a supporter seeking our coverage sent her a message in which I questioned the prospects of her campaign.

But getting progressive support in a race against Pelosi in San Francisco clearly isn’t the same thing as having a progressive campaign gain traction with a statewide audience, particularly because Sheehan doesn’t have many prominent endorsers or organizational allies.

By contrast, Rodriguez seems to be outhustling Sheehan, racing up and the down the state to promote his candidacy and work on rebuilding the progressive movement, with an emphasis on reaching communities of color who feel estranged from politics.

“People like me and others on the left need to step up if we’re not going to just accept the control of the two-party system. We have to fight for that democratic reality, we have to make it real,” Rodriguez told us. “You can’t just say vote, vote, vote. You have to give them something to vote for.”

 

ON THE ISSUES

Rodriguez is the author of 15 books, including poetry, journalism, novels, and a controversial memoir on gang life, Always Running, winning major writing awards for his work. He lives in the Los Angeles area, where he’s been active in community-building in both the arts and political realms.

Rodriguez is running on a platform that brings together environmental, social justice, and anti-poverty issues, areas addressed separately by progressive groups who have made only halting progress on each, “which is why we need to make them inseparable.”

While he said Brown has improved the “terrible situation he inherited from Schwarzenegger,” Rodriguez said that the fortunes of the average Californian haven’t turned around.

“People are hurting in the state of California. I think Brown has to answer for that,” Rodriguez said, noting that people are frustrated with the economic system and looking for solutions. “I don’t think Gov. Brown has a plan for it. In fact, I think he’s making it worse.”

Sheehan is critical of Brown for his opposition to full marijuana legalization, his resistance to prison reform, for allowing fracking, and for doing little to challenge the consolidation of wealth.

“My main issue is always, of course, peace and justice. But a corollary of that is for the resources of this state to be more fairly distributed to help people’s lives,” Sheehan said, calling that economic justice stand an outgrowth of her anti-war activism. “Since my son was killed, I’ve been starting to connect the dots about the empire we live under.”

When she studied California history at UCLA, Sheehan said, “I was inspired by Upton Sinclair and his End Poverty In California campaign in the ’30s.” She reminisces about the California of her childhood, when college education was free and the social safety net was intact, keeping people from economic desperation.

“It’s been done before and we can do it again,” Sheehan said. “I love this state, I love its potential, and I miss the way it was when I was growing up.”

 

OBSTACLES TO OVERCOME

Money is a challenge for statewide candidates given the size of California, which has at least a half-dozen major media markets that all need to be tapped repeatedly to reach voters throughout the state.

“I won’t take any corporate dollars and only people with money get heard,” Rodriguez told us.

But he says California has a large and growing number of voters who don’t identify with either major party, as well as a huge number of Latino voters who have yet to really make their voices heard at election time.

“I’m really banking on the people that nobody is counting,” Rodriguez said. “This is the time when people need to come together. We have to unite on these central things.”

That’s always a tough task for third-party candidates. Sheehan has a paltry list of endorsers, owing partly to the left-leaning organizations like labor unions staying with Brown, even though Sheehan claims many of their members support her.

“The rank and file is supportive of our message, but the leadership is still tied in with the Democratic Party,” Sheehan told us. “This state is deeply controlled by the Democratic Party, even more than it was a few years ago.”

But Sheehan considers herself a strong and seasoned candidate. “I’ve run for Congress, I’ve run for vice president, and I think that politics should be local,” Sheehan told us, saying her main strength would be, “I would work with people to create a better state, not against people.”

It was a theme she returned to a few times in our conversation, her main selling point. “It’s about inspiring a movement,” Sheehan said. “My biggest gift is getting out there and talking to people.” But if her strengths are indeed inspiring a movement, working with allies, and building coalitions, then why isn’t her campaign doing those things? Sheehan admits that it’s been difficult, telling us, “I found it easier in San Francisco to get the word out.”

San Francisco Magazine just published an intriguing interview with Salesforce CEO Marc Benioff, and Benioff’s attitude and approach to San Francisco seems to be a striking contrast to the city’s other top tech titan, venture capitalist Ron Conway, who we profiled over a year ago.

While Conway burst onto the political scene a few years ago with a pledge to destroy the progressive movement in San Francisco, sponsoring Mayor Ed Lee and his allies as the main vehicle for those ambitions, Benioff is a San Francisco native who seems to understand this city’s values and accept the responsibilities that come with great wealth and power.

“I say, if you want to be in this city and take advantage of all this great infrastructure—our mass transit, our schools, our hospitals, the safety and stability that we have—then also give back. These are the table stakes for doing business here. This is not a new idea,” Benioff told San Francisco Magazine Editor Jon Steinberg in this extended Q&A.

The news peg for the article was a new Benioff initiative in which he’s asking local tech companies to contribute $500,000 each to Tipping Point Community, which funds local community service programs, an effort that Benioff calls SF Gives.

“The first person I called was Ron Conway. I said, ‘Ron, what we’re going to do is get companies to give $500,000, and I’m going to raise $10 million, and we are going to give back to S.F. en masse with money from organizations, not just individuals.’ He said, ‘This is never gonna work. I run sf.citi [a political advocacy group for 500 local tech companies], and people won’t even pay their dues. You’re not going to raise millions of dollars,’” Benioff told the magazine.

The difference is that Conway is pushing an aggressive political agenda, seeking business tax breaks and special treatment from City Hall for the companies he’s invested in while being tone-deaf to the political backlash it’s causing in San Francisco, one that Benioff acknowledges and says the industry must address.

“Because this is not about any political agenda. It’s not. It’s about pure-play philanthropy: giving back to nonprofits and NGOs that can make a difference in S.F,” was how Benioff answered the question about why companies are more willing to donate to SF Gives than sf.citi.

As we documented in our profile of Conway, this guy is a old school conservative with a history of right-wing politics who conveniently dropped his Republican Party affiliation when he arrived in San Francisco pushing an aggressive pro-business agenda.

As we wrote in our article about an event seven years ago when Conway burst onto the scene and declared his intentions: “’This guy stood up and said that we have to take the city back from the progressives,’ [former Mayor Art] Agnos told us. ‘I barely knew who he was. I’ve been in San Francisco since 1966, and here he comes telling us what to do.;”

To understand this tale of two tech titans, contrast that approach with this comment from Benioff: “It’s a city of innovation, of flamboyance, of transformation, and during boom times, S.F. always changes and evolves. But tied into that has always been generosity: the Haas family, the Hellmans, the Fishers, the Shorensteins. During every one of these boom times, the people who benefited the most were also giving back the most. But this time around, we haven’t been able to talk about a broad philanthropic effort to couple with the growth. So this seemed like a great opportunity.”

Supervisors outfox landlords on eviction compensation measure UPDATED

When the San Francisco Board of Supervisors gave final approval yesterday [Tues/15] to legislation that would substantially increase the payments landlords are required to give tenants they evict using the Ellis Act, the supervisors made a key change designed to counter a recent eviction push by landlords.

The legislation, approved on a 9-2 vote with Sups. Mark Farrell and Katy Tang opposed, increases the current required relocation payments of $5,265 per person or $15,795 per unit (plus an additional $3,510 for those with disabilities or over age 62) up to the equivilent of two years rent for a comparable unit, which means tens of thousands of dollars.

For example, the Controller’s Office calculates that a family evicted from a two-bedroom apartment in the Mission District where they pay $909 per month would be entitled to $44,833 in relocation costs.

The legislation was originally scheduled to go into effect 120 days after passage in order to give city officials enough time to implement it. But after sponsoring Sup. David Campos heard that landlords were rushing to evict tenants before those fees went up, he checked in with the City Attorney’s Office and other departments to see whether they could be ready sooner. And after getting the greenlight, he amended  the measure yesterday to go into effect 30 days after it’s enacted into law.

The question now is whether Mayor Ed Lee, who has not taken a position on the legislation, will act quickly to sign it. He has 10 days to decide, and given that the legislation was approved by a veto-proof majority, the question is really whether the mayor will support stalling the inevitable, thus encouraging more evictions at lower levels of relocation assistance.

But Mayor Lee has publicly touted his concerns about the eviction epidemic and support for Sen. Mark Leno’s Ellis Act reform legislation, SB1439. So I’m sure Lee is warming up his pen and preparing to sign the measure as I write this, right? We’ve got a message into his office with that question and I’ll update this post when we hear back.

UPDATE 4/18: Christine Falvey, the mayor’s press secretary, just finally responded to our inquiry and said, “The Mayor is reviewing and considering this legislation. I will keep you updated.” Apparently, he doesn’t feel the same sense of urgency that supporters of the measure feel. 

UPDATE 5/6: Mayor Lee waited 10 days and then allowed the measure to become law without his signature. 

Lucifer is such a drag

LIT In this workaday world we live in, it’s good to inject a little weirdness. Mix in moments of the metaphysical and dabs of the divine into our banal, everyday existence. And you can start by grabbing a copy of The Weirdness (Melville House, 288 pp., $16.95) and letting novelist Jeremy P. Bushnell do it for you.

The Faustian premise is a familiar one, with Lucifer showing up in hapless aspiring writer Billy Ridgeway’s living room with that timeless offer of earthly greatness in exchange eternal servitude. Or something like that, because Billy is skeptical and won’t sit through the Devil’s PowerPoint presentation (yes, this is Faust in the Information Age) even though it comes with really great coffee.

From there, the journey begins, a slow buildup of character development to what becomes a wild ride navigating the battlefield between the Adversarial Manifestation and the human forces secretly arrayed against him, à la Harry Potter. But the real appeal of The Weirdness isn’t the plot, as fun and fantastical as it may be.

No, the moments when I found myself enjoying this novel the most, the times when I laughed or smiled to myself with appreciation at the strength of the writing by this debut novelist, was when we peeked inside Billy’s mind as the weirdness was unfolding around him.

Self-absorbed and filled with doubt, preoccupied with petty gripes and grievances, obsessing about that last tiff with his girlfriend, and wondering whether he’s doing it right, the world inside Billy’s mind is a comically hilarious counterpoint to the epic clash of good and evil that is unfolding around him. I wasn’t sure whether I wanted to slap the kid and give him a big hug, but either way it was the stuff that really elevated this novel.

In many ways, this is an illuminating parable for these times, particularly among the young technology and finance workers here in San Francisco, who obsess about the latest deal or app or foodie delight, oblivious to the epic struggles around them except for when those strange societies of passionate warriors confront them, when Billy and those who want nothing more than their own personal success and happiness are made aware that there are larger struggles going on in the world.

And then, Billy is mostly just irritated by the inconvenience of it all. When members of the Right-Hand Path try to help Billy break free from the clutches of the devil, he just won’t be told what to do or trouble himself with taking a stand, even though the secret cabal is based on the set of his favorite sci-fi television show, Argentium Astrum.

After all, these nerdy do-gooders took his cell phone and won’t give it back, so Billy thinks that maybe he’s better off working with Lucifer, who is at least offering to get his novel published, even though his own father turns out to be a top tier warrior against Satan, which causes poor Billy to feel more betrayed than loved or saved.

Don’t worry, Billy is a piece of work, but he grows on you, even if you want to smack his whiny ass at times and maybe find yourself hoping the ever-charming Lucifer wins and subjects this kid to eternal hellfire. But by time Krishna shows up to save the day, you’ll just wish you had more of this delightful novel still left to read. *

 

Save the world, work less

Save the world, work less. That dual proposition should have universal appeal in any sane society. And those two ideas are inextricably linked by the realities of global climate change because there is a direct connection between economic activity and greenhouse gas emissions.

Simply put, every hour of work we do cooks the planet and its sensitive ecosystems a little bit more, and going home to relax and enjoy some leisure time is like taking this boiling pot of water off the burner.

Most of us burn energy getting to and from work, stocking and powering our offices, and performing the myriad tasks that translate into digits on our paychecks. The challenge of working less is a societal one, not an individual mandate: How can we allow people to work less and still meet their basic needs?

This goal of slowing down and spending less time at work — as radical as it may sound — was at the center of mainstream American political discourse for much of our history, considered by thinkers of all ideological stripes to be the natural endpoint of technological development. It was mostly forgotten here in the 1940s, strangely so, even as worker productivity increased dramatically.

But it’s worth remembering now that we understand the environmental consequences of our growth-based economic system. Our current approach isn’t good for the health of the planet and its creatures, and it’s not good for the happiness and productivity of overworked Americans, so perhaps it’s time to revisit this once-popular idea.

Last year, there was a brief burst of national media coverage around this “save the world, work less” idea, triggered by a report by the Washington DC-based Center for Economic and Policy Research, entitled “Reduced Work Hours as a Means of Slowing Climate Change.”

“As productivity grows in high-income, as well as developing countries, social choices will be made as to how much of the productivity gains will be taken in the form of higher consumption levels versus fewer work hours,” author David Rosnick wrote in the introduction.

He notes that per capita work hours were reduced by 50 percent in recent decades in Europe compared to US workers who spend as much time as ever on the job, despite being a world leader in developing technologies that make us more productive. Working more means consuming more, on and off the job.

“This choice between fewer work hours versus increased consumption has significant implications for the rate of climate change,” the report said before going on to study various climate change and economic growth models.

It isn’t just global warming that working less will help address, but a whole range of related environmental problems: loss of biodiversity and natural habitat; rapid depletion of important natural resources, from fossil fuel to fresh water; and the pollution of our environment with harmful chemicals and obsolete gadgets.

Every day that the global workforce is on the job, those problems all get worse, mitigated only slightly by the handful of occupations devoted to cleaning up those messes. The Rosnick report contemplates only a slight reduction in working hours, gradually shaving a few hours off the week and offering a little more vacation time.

“The paper estimates the impact on climate change of reducing work hours over the rest of the century by an annual average of 0.5 percent. It finds that such a change in work hours would eliminate about one-quarter to one-half of the global warming that is not already locked in (i.e. warming that would be caused by 1990 levels of greenhouse gas concentrations already in the atmosphere),” the report concludes.

What I’m talking about is something more radical, a change that meets the daunting and unaddressed challenge that climate change is presenting. Let’s start the discussion in the range of a full day off to cutting our work hours in half — and eliminating half of the wasteful, exploitive, demeaning, make-work jobs that this economy-on-steroids is creating for us, and forcing us to take if we want to meet our basic needs.

Taking even a day back for ourselves and our environment will seem like crazy-talk to many readers, even though our bosses would still command more days each week than we would. But the idea that our machines and other innovations would lead us to work far less than we do now — and that this would be a natural and widely accepted and expected part of economic evolution — has a long and esteemed philosophical history.

Perhaps this forgotten goal is one worth remembering at this critical moment in our economic and environmental development.

 

HISTORY LESSON

Author and historian Chris Carlsson has been beating the “work less” drum in San Francisco since Jimmy Carter was president, when he and his fellow anti-capitalist activists decried the dawning of an age of aggressive business deregulation that continues to this day.

They responded with creative political theater and protests on the streets of the Financial District, and with the founding of a magazine called Processed World, highlighting how new information technologies were making corporations more powerful than ever without improving the lives of workers.

“What do we actually do all day and why? That’s the most basic question that you’d think we’d be talking about all the time,” Carlsson told us. “We live in an incredibly powerful and overarching propaganda society that tells you to get your joy from work.”

But Carlsson isn’t buying it, noting that huge swaths of the economy are based on exploiting people or the planet, or just creating unproductive economic churn that wastes energy for its own sake. After all, the Gross Domestic Product measures everything, the good, the bad, and the ugly.

“The logic of growth that underlies this society is fundamentally flawed,” Carlsson said. “It’s the logic of the cancer cell — it makes no sense.”

What makes more sense is to be smart about how we’re using our energy, to create an economy that economizes instead of just consuming everything in its path. He said that we should ask, “What work do we need to do and to what end?”

We used to ask such questions in this country. There was a time when working less was the goal of our technological development.

“Throughout the 19th century, and well into the 20th, the reduction of worktime was one of the nation’s most pressing issues,” professor Juliet B. Schor wrote in her seminal 1991 book The Overworked American: The Unexpected Decline of Leisure. “Through the Depression, hours remained a major social preoccupation. Today these debates and conflicts are long forgotten.”

Work hours were steadily reduced as these debates raged, and it was widely assumed that even greater reductions in work hours was all but inevitable. “By today, it was estimated that we could have either a 22-hour week, a six-month workyear, or a standard retirement age of 38,” Schor wrote, citing a 1958 study and testimony to Congress in 1967.

But that didn’t happen. Instead, declining work hours leveled off in the late 1940s even as worker productivity grew rapidly, increasing an average of 3 percent per year 1948-1968. Then, in the 1970s, workers in the US began to work steadily more hours each week while their European counterparts moved in the opposite direction.

“People tend to think the way things are is the way it’s always been,” Carlsson said. “Once upon a time, they thought technology would produce more leisure time, but that didn’t happen.”

Writer David Spencer took on the topic in a widely shared essay published in The Guardian UK in February entitled “Why work more? We should be working less for a better quality of life: Our society tolerates long working hours for some and zero hours for others. This doesn’t make sense.”

He cites practical benefits of working less, from reducing unemployment to increasing the productivity and happiness of workers, and cites a long and varied philosophical history supporting this forgotten goal, including opposing economists John Maynard Keynes and Karl Marx.

Keynes called less work the “ultimate solution” to unemployment and he “also saw merit in using productivity gains to reduce work time and famously looked forward to a time (around 2030) when people would be required to work 15 hours a week. Working less was part of Keynes’s vision of a ‘good society,'” Spencer wrote.

“Marx importantly thought that under communism work in the ‘realm of necessity’ could be fulfilling as it would elicit and harness the creativity of workers. Whatever irksome work remained in realm of necessity could be lessened by the harnessing of technology,” Spencer wrote.

He also cited Bertrand Russell’s acclaimed 1932 essay, “In Praise of Idleness,” in which the famed mathematician reasoned that working a four-hour day would cure many societal ills. “I think that there is far too much work done in the world, that immense harm is caused by the belief that work is virtuous, and that what needs to be preached in modern industrial countries is quite different from what always has been preached,” Russell wrote.

Spencer concluded his article by writing, “Ultimately, the reduction in working time is about creating more opportunities for people to realize their potential in all manner of activities including within the work sphere. Working less, in short, is about allowing us to live more.”

 

JOBS VS. WORK

Schor’s research has shown how long working hours — and the uneven distribution of those hours among workers — has hampered our economy, hurt our environment, and undermined human happiness.

“We have an increasingly poorly functioning economy and a catastrophic environmental situation,” Schor told us in a phone interview from her office at Boston College, explaining how the increasingly dire climate change scenarios add urgency to talking about how we’re working.

Schor has studied the problem with other researchers, with some of her work forming the basis for Rosnick’s work, including the 2012 paper Schor authored with University of Alabama Professor Kyle Knight entitled “Could working less reduce pressures on the environment?” The short answer is yes.

“As humanity’s overshoot of environmental limits become increasingly manifest and its consequences become clearer, more attention is being paid to the idea of supplanting the pervasive growth paradigm of contemporary societies,” the report says.

The United States seems to be a case study for what’s wrong.

“There’s quite a bit of evidence that countries with high annual work hours have much higher carbon emissions and carbon footprints,” Schor told us, noting that the latter category also takes into account the impacts of the products and services we use. And it isn’t just the energy we expend at work, but how we live our stressed-out personal lives.

“If households have less time due to hours of work, they do things in a more carbon-intensive way,” Schor said, with her research finding those who work long hours often tend to drive cars by themselves more often (after all, carpooling or public transportation take time and planning) and eat more processed foods.

Other countries have found ways of breaking this vicious cycle. A generation ago, Schor said, the Netherlands began a policy of converting many government jobs to 80 percent hours, giving employees an extra day off each week, and encouraging many private sector employers to do the same. The result was happier employees and a stronger economy.

“The Netherlands had tremendous success with their program and they’ve ended up with the highest labor productivity in Europe, and one of the happiest populations,” Schor told us. “Working hours is a triple dividend policy change.”

By that she means that reducing per capita work hours simultaneously lowers the unemployment rate by making more jobs available, helps address global warming and other environmental challenges, and allows people to lead happier lives, with more time for family, leisure, and activities of their choosing.

Ironically, a big reason why it’s been so difficult for the climate change movement to gain traction is that we’re all spending too much time and energy on making a living to have the bandwidth needed to sustain a serious and sustained political uprising.

When I presented this article’s thesis to Bill McKibben, the author and activist whose 350.org movement is desperately trying to prevent carbon concentrations in the atmosphere from passing critical levels, he said, “If people figure out ways to work less at their jobs, I hope they’ll spend some of their time on our too-often neglected work as citizens. In particular, we need a hell of a lot of people willing to devote some time to breaking the power of the fossil fuel industry.”

That’s the vicious circle we now find ourselves in. There is so much work to do in addressing huge challenges such as global warming and transitioning to more sustainable economic and energy systems, but we’re working harder than ever just to meet our basic needs — usually in ways that exacerbate these challenges.

“I don’t have time for a job, I have too much work to do,” is the dilemma facing Carlsson and others who seek to devote themselves to making the world a better place for all living things.

To get our heads around the problem, we need to overcome the mistaken belief that all jobs and economic activity are good, a core tenet of Mayor Ed Lee’s economic development policies and his relentless “jobs agenda” boosterism and business tax cuts. Not only has the approach triggered the gentrification and displacement that have roiled the city’s political landscape in the last year, but it relies on a faulty and overly simplistic assumption: All jobs are good for society, regardless of their pay or impact on people and the planet.

Lee’s mantra is just the latest riff on the fabled Protestant work ethic, which US conservatives and neoliberals since the Reagan Era have used to dismantle the US welfare system, pushing the idea that it’s better for a single mother to flip our hamburgers or scrub our floors than to get the assistance she needs to stay home and take care of her own home and children.

“There is a belief that work is the best form of welfare and that those who are able to work ought to work. This particular focus on work has come at the expense of another, far more radical policy goal, that of creating ‘less work,'” Spencer wrote in his Guardian essay. “Yet…the pursuit of less work could provide a better standard of life, including a better quality of work life.”

And it may also help save us from environmental catastrophe.

 

GLOBAL TIPPING POINT

The Intergovernmental Panel on Climate Change, the top research body on the issue recognized by the United Nations, recently released its fifth report summarizing and analyzing the science and policies around climate change, striking a more urgent tone than in previous reports.

On April 13 at a climate conference in Berlin, the panel released a new report noting that greenhouse gas emissions are rising faster than ever and urgent action is needed in the next decade to avert a serious crisis.

“We cannot afford to lose another decade,” Ottmar Edenhofer, a German economist and co-chairman of the committee that wrote the report, told The New York Times. “If we lose another decade, it becomes extremely costly to achieve climate stabilization.”

After the panel released an earlier section of the report on March 31, it wrote in a public statement: “The report concludes that responding to climate change involves making choices about risks in a changing world. The nature of the risks of climate change is increasingly clear, though climate change will also continue to produce surprises.”

The known impacts will be displaced populations in poor countries inundated by rising seas, significant changes to life-supporting ecosystems (such as less precipitation in California and other regions, creating possible fresh water shortages), food shortages from loss of agricultural land, and more extreme weather events.

What we don’t yet know, these “surprises,” could be even scarier because this is such uncharted territory. Never before have human activities had such an impact on the natural world and its delicate balances, such as in how energy circulates through the world’s oceans and what it means to disrupt half of the planet’s surface area.

Researchers have warned that we could be approaching a “global tipping point,” in which the impact of climate change affects other systems in the natural world and threatens to spiral out of control toward another mass extinction. And a new report funded partially by the National Science Foundation and NASA’s Goodard Space Center combines the environmental data with growing inequities in the distribution of wealth to warn that modern society as we know it could collapse.

“The fall of the Roman Empire, and the equally (if not more) advanced Han, Mauryan, and Gupta Empires, as well as so many advanced Mesopotamian Empires, are all testimony to the fact that advanced, sophisticated, complex, and creative civilizations can be both fragile and impermanent,” the report warned.

It cites two critical features that have triggered most major societal collapses in past, both of which are increasingly pervasive problems today: “the stretching of resources due to the strain placed on the ecological carrying capacity”; and “the economic stratification of society into Elites [rich] and Masses (or ‘Commoners’),” which makes it more difficult to deal with problems that arise.

Both of these problems would be addressed by doing less overall work, and distributing the work and the rewards for that work more evenly.

 

SYSTEMIC PROBLEM

Carol Zabin — research director for the Center for Labor Research and Education at UC Berkeley, who has studied the relation between jobs and climate change — has some doubts about the strategy of addressing global warming by reducing economic output and working less.

“Economic activity which uses energy is not immediately correlated with work hours,” she told us, noting that some labor-saving industrial processes use more energy than human-powered alternatives. And she also said that, “some leisure activities could be consumptive activities that are just as bad or worse than work.”

She does concede that there is a direct connection between energy use and climate change, and that most economic activity uses energy. Zabin also said there was a clear and measurable reduction in greenhouse gas emissions during the Great Recession that began with the 2008 economic crash, when economic growth stalled and unemployment was high.

“When we’re in recessions and output and consumption slow, we see a reduction in impact on the climate,” Zabin said, although she added, “They’re correlated, but they’re not causal.”

Other studies have made direct connections between work and energy use, at least when averaged out across the population, studies that Rosnick cited in his study. “Recent work estimated that a 1 percent increase in annual hours per employee is associated with a 1.5 percent increase in carbon footprint,” it said, citing the 2012 Knight study.

Zabin’s main stumbling block was a political one, rooted in the assumption that American-style capitalism, based on conspicuous consumption, would continue more or less as is. “Politically, reducing economic growth is really, really unviable,” she told us, noting how that would hurt the working class.

But again, doesn’t that just assume that the pain of an economic slowdown couldn’t be more broadly shared, with the rich absorbing more of the impact than they have so far? Can’t we move to an economic system that is more sustainable and more equitable?

“It seems a little utopian when we have a problem we need to address by reducing energy use,” Zabin said before finally taking that next logical step: “If we had socialism and central planning, we could shut the whole thing down a notch.”

Instead, we have capitalism, and she said, “we have a climate problem that is probably not going to be solved anyway.”

So we have capitalism and unchecked global warming, or we can have a more sustainable system and socialism. Hmm, which one should we pick? European leaders have already started opting for the latter option, slowing down their economic output, reducing work hours, and substantially lowering the continent’s carbon footprint.

That brings us back to the basic question set forth in the Rosnick study: As productivity increases, should those gains go to increase the wages of workers or to reduce their hours? From the perspective of global warming, the answer is clearly the latter. But that question is complicated in US these days by the bosses, investors, and corporations keeping the productivity gains for themselves.

“It is worth noting that the pursuit of reduced work hours as a policy alternative would be much more difficult in an economy where inequality is high and/or growing. In the United States, for example, just under two-thirds of all income gains from 1973-2007 went to the top 1 percent of households. In that type of economy, the majority of workers would have to take an absolute reduction in their living standards in order to work less. The analysis of this paper assumes that the gains from productivity growth will be more broadly shared in the future, as they have been in the past,” the study concludes.

So it appears we have some work to do, and that starts with making a connection between Earth Day and May Day.

 

EARTH DAY TO MAY DAY

The Global Climate Convergence (www.globalclimateconvergence.org) grew out of a Jan. 18 conference in Chicago that brought together a variety of progressive, environmental, and social justice groups to work together on combating climate change. They’re planning “10 days to change course,” a burst of political organizing and activism between Earth Day and May Day, highlighting the connection between empowering workers and saving the planet.

“It provides coordinated action and collaboration across fronts of struggle and national borders to harness the transformative power we already possess as a thousand separate movements. These grassroots justice movements are sweeping the globe, rising up against the global assault on our shared economy, ecology, peace and democracy. The accelerating climate disaster, which threatens to unravel civilization as soon as 2050, intensifies all of these struggles and creates new urgency for collaboration and unified action. Earth Day to May Day 2014 (April 22 — May 1) will be the first in a series of expanding annual actions,” the group announced.

San Mateo resident Ragina Johnson, who is coordinating events in the Bay Area, told us May Day, the international workers’ rights holiday, grew out of the struggle for the eight-hour workday in the United States, so it’s appropriate to use the occasion to call for society to slow down and balance the demands of capital with the needs of the people and the planet.

“What we’re seeing now is an enormous opportunity to link up these movements,” she told us. “It has really put us on the forefront of building a new progressive left in this country that takes on these issues.”

In San Francisco, she said the tech industry is a ripe target for activism.

“Technology has many employees working 60 hours a week, and what is the technology going to? It’s going to bottom line profits instead of reducing people’s work hours,” she said.

That’s something the researchers have found as well.

“Right now, the problem is workers aren’t getting any of those productivity gains, it’s all going to capital,” Schor told us. “People don’t see the connection between the maldistribution of hours and high unemployment.”

She said the solution should involve “policies that make it easier to work shorter hours and still meet people’s basic needs, and health insurance reform is one of those.”

Yet even the suggestion that reducing work hours might be a worthy societal goal makes the head of conservatives explode. When the San Francisco Chronicle published an article about how “working a bit less” could help many people qualify for healthcare subsidies under the Affordable Care Act (“Lower 2014 income can net huge health care subsidy,” 10/12/13), the right-wing blogosphere went nuts decrying what one site called the “toxic essence of the welfare state.”

Chronicle columnist Debra Saunders parroted the criticism in her Feb. 7 column. “The CBO had determined that ‘workers will choose to supply less labor — given the new taxes and other incentives they will face and the financial benefits some will receive.’ To many Democrats, apparently, that’s all good,” she wrote of Congressional Budget Office predictions that Obamacare could help reduce hours worked.

Not too many Democratic politicians have embraced the idea of working less, but maybe they should if we’re really going to attack climate change and other environmental challenges. Capitalism has given us great abundance, more than we need and more than we can safely sustain, so let’s talk about slowing things down.

“There’s a huge amount of work going on in society that nobody wants to do and nobody should do,” Carlsson said, imagining a world where economic desperation didn’t dictate the work we do. “Most of us would be free to do what we want to do, and most of us would do useful things.”

And what about those who would choose idleness and sloth? So what? At this point, Mother Earth would happily trade her legions of crazed workaholics for a healthy population of slackers, those content to work and consume less.

Maybe someday we’ll even look back and wonder why we ever considered greed and overwork to be virtues, rather than valuing a more healthy balance between our jobs and our personal lives, our bosses and our families, ourselves and the natural world that sustains us.
