#OpenData just got a teeny bit more open

We were disheartened when, after submitting some fairly innocuous questions to the Mayor’s Chief Innovation Officer, Jay Nath, we received zero answers. By the time the Guardian’s annual Freedom of Information issue hit stands yesterday, we were still out in the cold. (Shameless plug: Pick up a print edition of this week’s paper for our flow chart on how to file Sunshine requests, designed by our illustrious Art Director Brooke Robertson.)

Nath, who helped start the city’s Open Data program, responded to our emails and tweets (apologetically) by saying he was awaiting the green light from the Mayor’s Office of Communications. Which begs the question: In a city so outwardly committed to transparency, why can’t the Mayor’s Office of Communications entrust a program expert to share information about information-sharing software?

Anyway, the day after we ran our story, Nath did respond in an email. The first objective of Open Data is to “increase transparency,” he told us.

Other goals are to “drive economic development” and “foster the creation of new services and analysis by our community.” The inspiration behind it came from President Barack Obama, who on his first day in office “issued a memo on open government that heralded their open data program Data.gov,” Nath explained. “With this precedent, the city recognized an opportunity to share local data with the public.” 

Head over to the city’s Open Data Portal and you can poke around for info on everything from real-estate development, to restaurant health inspection scores, to city salary ranges by job classification.

As Nath pointed out, there are also over 30 datasets around campaign finance. That’s a good thing – but there’s still room for improvement. Last year, after attending a city hackathon where transparency advocates hoped to spur creation of an app to track lobbying, campaign contributions and real-estate development, Adriel Hampton of the San Francisco Technology Democrats noted that this was impossible due to a lack of information. “Despite millions in spending on … online transparency measures, access to data in these areas is woefully lacking,” Hampton wrote.

Nath said the annual cost is $40,000 per year for software. He also shared his vision for future expansion. “In terms of new services, I see applications that mash up data from multiple public and private sources to create a seamless experience,” he said. “For example, imagine a tourism app that helps you navigate the city via public transit, taxis, car / bike sharing, biking, walking, etc.”

So how does Open Data affect public records requests under the San Francisco Sunshine Ordinance? “Government can use open data to reduce costs by pro-actively providing information that is often requested through FOIA,” Nath told us, referring to the Freedom of Information Act. “For example, by releasing real-time transit data, transit riders have dozens of ways to know when their next bus is coming. This new and immediate access to information has resulted in 21.7% fewer SF 311 calls – and at $2 per call – that yielded a savings of over $1 million a year.”

An interesting thing about data is that it can be totally neutral until it’s harnessed for a particular purpose, with clever visualization and presentation. Just ask the producer of this video on wealth distribution, which has been making the rounds.

Just ignore the Chamber of Commerce

The Chronicle made a big deal of the fact that the Chamber of Commerce has a “21-point advocacy agenda” that “could weaken” the city’s “boundry pushing legislation and pro-labor policies.”

But really, nobody should even care.

The Chamber’s been pretty irrelevant to local politics for years now, and there’s no way six members of the Board of Supervisors are going to take the backward-thinking group up on its efforts to contract out city services and slow down cutting-edge proposals.

Actually, most of the “21-point agenda” is pretty tame. The Chamber, for example, wants to “Work with city government and advocacy groups to improve the ability of residents and visitors to move efficiently around the City by car, transit, bike and taxis.” And it hopes to “Continue to promote San Francisco’s small businesses through formulating favorable public policies and providing ample networking opportunities.” Wow. Hold the front page.

As for the things that might actually matter, forget it. Contracting out comes up almost every year at budget time; every year, a unified labor community shoots it down. This year will be the same. And nobody’s going to get City Attorney Dennis Herrera to release a public analysis of every piece of legislation before it’s approved.

Herrera’s better than his predecessors, by far, but he’s a lawyer, and lawyers don’t like to share with anyone the advice they give their clients. I often wish Herrera’s office would release more than it does, but unless the supervisors declare that they no longer want confidential advice from their attorney (which has its charm, to be sure, but also some real downsides) then the current policy will continue. Herrera will privately tell board members that there might be legal risks to some of their bills; the elected supervisors will decide whether to take those risks or not.

While I’m always an advocate of open government, the city attorney is not the Supreme Court. In the really bad old days, a city attorney named George Agnost used to routinely shut down progressive legislation by announcing that it was unconstitutional, leaving even conservative members of the board to denounce him. When the supes pass something, it’s a presumptively valid law. If you don’t like it, you can sue. The courts — not the city attorney — decide what’s legal and what isn’t.

And I have no idea where the Chamber’s Jim Lazarus came up with this:

But prior to Herrera and his predecessor, Louise Renne, city attorneys regularly issued public opinions, said Lazarus, a deputy city attorney in the 1970s who lost to Herrera in the 2001 election.

That’s completely untrue. I know; when Agnost was city attorney (in the 1970s and early 1980s) I tried constantly to get copies of his legal opinions. The vast majority were never released. That office was so secretive the city attorney wouldn’t even tell you his name if it wasn’t written on the door. When I pushed the issue, Agnost told me that copies of every non-confidential opinion he’d ever written were available at the public library. I went there. There were exactly three opinions on file, all of them noncontroversial and unrelated to any pending legislation.

Look, we all know that Gavin Newsom pushed the boundries of law when he approved same-sex marriages. But the California Supreme Court, faced with San Francisco’s civic disobedience, changed the law and said marriage was a basic right. And the US Supreme Court is about to do the same thing. Is the Chamber arguing that Newsom was wrong?

The Chamber is yesterday’s news. I don’t even know why we pay attention any more.

 

 

 

Are the new ride-shares unsafe?

Interesting letter to sfist, which typically loves the new rideshare companies like Lyft and Sidecar. The writer, apparently a cab driver, makes clear why these unlicensed cabs are a problem:

Taxi drivers are professional drivers with hundreds of thousands of city miles under their belts, intensive knowledge of city streets and each vehicle is inspected twice a year by the government of San Francisco and the SFO Airport Authority. These inspections insure that the three GPS tracking units, full motion video cameras, radios and other safety equipment is functioning and that the car is in compliance with DOT rules and regulations.

Yes, some cabbies are assholes, and yes, some cabbies don’t know their way to certain places in the city, and of course some cabbies drive like crazed maniacs. Sadly though the more Lyft and Sidecar operate and undercut the legitimate transportation services the more often this will happen. How would you feel if you had spent countless dollars and hours getting to do your job for crappy pay and to be treated like shit, only to have someone come in that didn’t do what you had to to get your job and do essentially the same thing for less money… making it so you couldn’t feed your kids, or pay your rent

Lyft and Sidecar are very dangerous for the city and the traveling public by putting un-licensed, uninsured, untrained, amateur drivers on the streets.

 

TIme to call these what they are — taxis — and make them get permits like every other taxi in the city.

More unregulated cabs on the street

So the state regulators have decided that it’s just fine for companies that pretend not to be taxi operators to operate taxis in San Francisco. That means Lyft and Uber can keep picking up passengers, charging them a “recommended donation” and avoiding the regulations that San Francisco wisely put in place to protect the public.

But the fact that the state thinks this is just fine and dandy, for now anyway, doesn’t mean San Francisco has to do the same. This city has the right to put rules in place for people conveying passengers within its 49 square miles — and those rules ought to apply to Lyft and Uber and Sidecar, too.

Cabs have to carry medallions, or permits. There are a limited number, and they can’t be owned by corporations, only by active cab drivers. You can buy one now — for about $200,000 — or you can get in line and wait, for about 15 years. If the city wants more cabs on the streets and likes the Lyft model, fine: The Municipal Transportation Agency can issue more permits, and if the venture capitalists backing Lyft want to pay for them, they can do so.

I’m not against Lyft or anyone else who has a good idea to serve the public in a way that isn’t being offered now, and I agree that this is the kick in the pants a slow-moving industry needs to develop (fairly simple) apps that allow people to figure out where the nearest cab is and when it’s coming.

But right now, we have an unregulated industry operating in competition with a heavily regulated industry, and it’s not fair. The City Attorney’s Office ought to look into this; the supervisors ought to investigate and force the newcomers to follow the rules. Sure: Lyft. But not this way.

A cab driver’s lament

OPINION I’m a San Francisco taxi driver. The reality on the streets is terrible.

Cab drivers are being squeezed from all sides. The Municipal Transportation Agency is part of the problem, because for the past year or so it has been energetically focused on enhancing the city’s revenues by selling taxi medallions (for $200,000) and putting hundreds of new cabs in service, at the expense of drivers.

That happened to coincide with the introduction of Sidecar and Lyft, to which the MTA’s response is painfully slow and ineffective. Neither problem is being resolved to the benefit of drivers.

SideCar and Lyft pretend that they’re just folks doing community service car-pooling, while being backed by millions of venture capital dollars. They are trying to be taxi services while avoiding using the word “taxi” in their names. They don’t want to talk about driver safety or insurance issues.

Cab drivers are heavily regulated for a reason — for your safety. There is accountability in the system.

There is no oversight of the new industry interlopers. The way these companies operate is not safe and not legal. When I went through my city-required week of driver training, photographing, fingerprinting, background check, and fee paying, everyone involved took it very seriously. If a cab driver screws up in any way, the company pulls him or her off the street.

Taxi drivers are held to a high standard of performance. We’re not the pizza delivery guy who’s now using his car to “ride-share” people around. Most of the time that won’t matter — until it really does matter. With SideCar and Lyft, if something goes wrong, you’ll find yourself with no protection and nowhere to turn.

I’m a night shift driver, and let me make it clear: Driving a taxi is a very hard job. You have to know the city, you have to deal with all kinds of people, have the patience of Job, make no mistakes, and be okay with little better than minimum wage — although there are no wages for cab drivers, what you make is whatever business you can manage to find — with no guarantees or benefits. The driver is the sole merchant, and he or she takes all the risks.

The regulatory framework needs to catch up with the technology, which is here to stay. The larger cab companies already use GPS technology. Luxor uses the “Taxi Magic” or “Cabulous” app to connect cabs to people who need rides.

But the taxi industry is already in a situation where, as a Guardian editorial noted, “too many cabs chasing too little money leads to bad behavior — and bad drivers.” The cease and desist order against the interlopers is being ignored. The fines imposed on them are being challenged and appealed.

So the industry is dysfunctional, with lawyers on all sides making things worse — and the drivers are the only ones who are suffering the consequences.

Cabs v. Lyft et. al. isn’t just about tech

Of course the Chron portrays it as “The latest battle pitting disruptive high-tech innovators against old-school industries and regulators,” because that makes for good copy. It also puts the taxicab industry and the people who oversee it in the position of being dinosaurs fighting against an inevitable new world.

But seriously: This has so little to do with smart phones and apps and GPS systems. Those are tools that anyone can use, and the local cab companies ought to and will soon anyway.

What it’s about is the notion that there are such things as public utilities that ought to be regulated in a way that protects the public.

San Francisco decided as a city many, many years ago that you can’t just stick a sign on your car, call yourself a taxi and start charging people for rides. That’s fairly standard practice in American cities, where cabs are considered part of the transportation system — and are a service that, without regulation, is ripe for consumer fraud and safety problems.

Not to make too broad a case, but in California, you can’t just hang out a sign and call yourself a contractor and start applying for building permits. You need a license. You can’t just open a bank and start making loans, at any interest rate you want. You can’t call yourself a dentist and start pulling teeth, either. There are good reasons for these rules. (I suppose some day someone will suggest that surgeons should be chosen not by the AMA or by state licensing boards but by Yelp; some guy cuts off the wrong part of the body or kills someone on the operating table? Hey, he won’t get a good rep on social media and his prices will have to come down. But I don’t think that’s such an excellent idea.)

Even conservatives agree that there needs to be some form of business regulation — and when it comes to cabs in a major urban center, those regulations need to include safety tests and standards on the vehicles, safety checks for drivers (a DUI in the past three years will make you ineligible to drive a cab in SF), a system to regulate fares (so tourists who don’t speak English or understand US currency don’t get cheated) and, perhaps most important, an oversight system that allows people to complain about incompetent or dangerous drivers — and have those complaints investigated and addressed by a government agency.

The battle between the new high(er)-tech faux cabs and the existing industry is also being portrayed as selfish, entitled drivers not wanting to give up their piece of the game:

SideCar’s Paul, a onetime congressional policy analyst, said the issue might eventually work its way up to the governor’s office, which oversees the commission. “The PUC has an existing set of rules that were written for an era when communication technology was literally just a landline telephone, and they’re trying to shoehorn them into this new world,” he said. SideCar is also using social media to drive support of an online petition to the PUC. Within 24 hours, the petition at Change.org had more than 5,000 signatures. “Change always threatens incumbents,” wrote Tim O’Reilly, a Sebastopol business owner. “But some incumbents find ways to get government on their side and try to restrict competition.”

But let’s have a little perspective here. We’re not talking about (unregulated) musicians complaining about MP3 downloads and song-sharing or old-school (unregulated) newspaper publishers complaining that Craigslist took all the classified ads. We’re talking about an industry that is part of a public infrastructure and needs to fall under direct government supervision.

There are good reasons why San Francisco limits the number of cabs on the streets — and it’s not just industry corruption and influence. Too many cabs chasing too little money leads to bad behavior — and to bad drivers. You can’t get someone to drive a cab for so little money that they can’t pay the rent, and the lower the pay, the lower the quality of the drivers. There are excellent cab drivers in this town who have been doing the job for 20 years or more and know every address, every shortcut, every trick to get you there … but there won’t be many more of them if it becomes a business only for the young and the desperate.

Now: The city ought to have a centralized computerized dispatch system, with GPS on all the cars and an app to get the one that’s clsoes to you (and even more important, give you honest, real-time information about when the ride will arrive). These are technological changes that are coming, and that the city can mandate.

But you can’t just let anyone with a smart phone be a cab driver. That’s not innovation against old-school; that’s just good common sense.

 

 

 

 

 

The unregulated cabs

EDITORIAL Yeah, the shared economy. Yeah, high tech. Yeah, there’s an app for that. Yeah, the San Francisco cab industry is screwed up and you can never get a cab when you need one.

But that’s not an excuse for the city to stand by and allow a whole cottage industry of unregulated, unlicensed cabs hit the streets, using a business model that everyone knows is fake and undermining decades of painstakingly crafted rules that govern this critical part of the city’s transportation infrastructure.

Over the past year, at least five new companies have opened that offer what the taxi industry offers — rides around the city for money. They do it in a cool new way — you send a message from your phone requesting a ride, you follow where the driver is with a GPS app, and when you get to the destination, you make a “voluntary” payment through a Pal-Pal-style system.

It sounds great: Fast service that the existing industry can’t always offer, an easier way to pay (a lot of drivers still demand cash only, in part because the cab companies charge drivers an extraordinary fee for credit-card transactions) and — more important to a lot of us — a way to know exactly when your ride will arrive. (Ever call a major cab dispatcher to ask when the car will be there? “As soon as he gets there,” is the usual gruff response. Sorry we asked.)

But there’s a reason that the city regulates taxis. Drivers are in constant contact with the public — with vulnerable people who may be tourists with limited English, seniors or others who could easily be exploited, or in the worst case scenario, harmed — so a background check is required for anyone who gets behind the wheel of a cab. Cabs have to carry extra insurance to cover passengers. There’s a city office where you can file complaints against unethical drivers. Companies won’t hire anyone with a serious infraction on his or her license.

There’s nothing, not a single rule or regulation, to protect customers of the new startups.

The city also controls the number of cabs on the streets — in part because too many cabs chasing too few fares leads to problems. You can’t legally drive a cab in the city — that is, pick up and discharge passengers for hire — without a city medallion.

The new companies, like Lyft and Sidecar, get around that rule by claiming the fare is just a “suggested donation” — which everyone knows is bogus. The companies would have no business model without charging money for rides.

The emergence of these new companies demonstrates how far behind the city and the taxi industry is — easier payment and more reliable service is such a mandate that customers are willing to go elsewhere when they don’t get it. But the idea that the free market and tech-savvy entrepreneurs will solve every problem clashes with the longtime, demonstrated need for regulations in the taxi industry.

City officials need to make it clear that they won’t allow these rogue cabs to keep operating. If the new outfits want to offer their services, they need to do what every other cab company does — line up medallions, follow the rules, get the proper insurance and operate within the law.

I’ve been wondering for months now how all of the rich people who come into San Francisco for the America’s Cup are going to get around. The event plans call for the Embarcadero to be closed during the festivities, which means no cars. The F-line is nice, but slow — and even with new trains, has limited capacity. And I don’t expect to see a lot of the millionaire yachting types riding the bus with us commoners.

Walk? Yeah, from a couple of blocks away, but not from hotels South of Market or on Nob Hill or Union Square. Not in their $500 shoes. Cabs? The traffic will be unbearable.

So here’s an idea I’ve heard floating around: The city makes the project sponsor (that’s you, Larry) buy a fleet of several hundred pedicabs, bicycle-powered taxis. Then the city hires hundreds of unemployed teenagers to drive the visitors from their hotels to the waterfront, giving local youth a chance to earn some money off the cup events. Ban all forms of motorized transportation — no limos, no town cars.

Advantages: Zero carbon emissions. No traffic jams. Youth employment. Healthy exercise. And think about the chariot-race-and-bumper-cars action that will give the swells a thrill. It’s a winner for everyone.

I’ve also been thinking about how the abomination of a condo project at 8 Washington is going to affect the festivities — and it’s a concern. The city has published reports on both the luxury condo project and the cup, and the folks working on the two don’t seem to be talking.

For example, the 8 Washington developer wants to excavate 110,000 tons of soil for a massive parking garage, from a spot right on the edge of the Embarcadero, right while all the cup events are taking place. Where are the dump trucks (hundreds of them every week) going to go if the Embarcadero is closed? How will that construction add to the congestion mess?

I’m not a fan of 8 Washington anyway. It’s a project designed to create the most expensive condos ever built in San Francisco — which is just what the city needs. More second or third homes for very rich people who won’t live here more than a few weeks a year. Another project that will put the city further out of synch with its own General Plan goals for affordable housing.

And building these units for the rich will interfere with the entertainment for the rich that’s supposed to trickle down to the rest of us. I wish it were just funny.

Couscous with Al Qaeda part 2

TRUE TRAVEL TALES: This is part two of Marke B.’s culinary journey through the Arab Spring. You can read part one — spicy! — here.

Before we left Tunis, the lovely people and open vibe of which which we’d rapidly fallen in love with, we ate at a mind-blowing West African lunch off a small street near the African Development Agency building, El Khalifa. Heaping plates of sauce-covered, deeply flavored attiéké poulet brasse (a creamy, manioc-based specialty of Côte d’Ivoire) and choucouya de poulet au cancancan, smothered with onions over berberé-spiked rice, were served cafeteria-style to a bustling room of suits talking international affairs in a head-swimming number of languages.

All the development-speak in the air got us scheming about how to bring more tourists back to this great city, with its intense cosmopolitan air, historical riches, and perfectly enchanting old city section — although we’d already witnessed one option in play: activist tourism

Fortunately or unfortunately, our hotel (the majestic, insanely reasonable Grand Hôtel de France, go stay there) had played host to a coterie of trendy-anarchisty Western student-types, perpetual cigarette smoke wreathing their immaculately styled dreadlocks. They had come, like us, to see the after-effects of the revolution and make contact with some of the people behind it. But they also wanted a piece of the action, joining demonstrations and breathlessly relating tales of being chased by police — before heading out for a day at the beach. Part of a loose organization called the Knowledge Liberation Front, they had gathered from all parts of Europe, hoping to formulate new models of resistance to the austerity measures sweeping the Union. (The fact that there were so many Italians there, raging against Berlusconi, was kind of encouraging.) They were cute! If, of course, deadly serious. Whatever Tunisian group that had facilitated their “revolution experience” certainly had a great thing started in terms of possible revenue streams.  

But now we were on our way south via Tunisia’s main railroad line, hoping to reach the Grand Erg Oriental, a rippling sea of sand in the Sahara that looks like the pictures in your head when you hear “Sahara.” From there, our ultimate destination would be El Ghriba on the island of Djerba, the oldest synagogue in North Africa, and its huge annual Lag B’Omer festival, which draws tens of thousands of Jews from around the world in a celebrated pilgrimage.

On the way, we stopped in El Djem, a neat little town that just so happens to contain a humungous, remarkably intact Roman coliseum-like amphitheatre, a 35,000-seat wonder built in the 3rd century (with ancient graffiti carved into its stone!), which we had practically to ourselves. It also has a well-designed museum of ravishing mosaics, including some depicting the martyrdom-by-wild-beasts that the amphitheatre (actually more like a killing factory, really) showcased. Innumerable christians and animals – including now-extinct species of elephants, tigers, even giraffes — were sacrificed horribly for the crowd’s entertainment.

We had the most extraordinary lunch. At Cafe Le Bonheur, a traditional central Tunisian feast with several salads and a main course of tender rabbit stewed in saffron, served in casual French style by a hip young waiter for cheap. Score! Some balmy afternoon time in cafes over cafe filter (coffee served in a glass) confirmed that El Djem is one of those magical little places you could sink into for a while.

The only other tourists in El Djem belonged to a random British family. Hang in there, Tunisia!

Then it was on to Gabes at the end of the train line, an unremarkable oil town (with attendant pollution — but also plentiful alcohol and solid business-traveler restaurants), where we planned to rent a car and drive to the desert. As soon as we got to Gabes, though, we saw our plans would be interrupted. The barbed-wire around the city square was not an encouraging sign. We were now officially in the south, where the revolution had started and which, with its large and impoverished Berber population, had always been restive. 

Now that the Libyan revolution had begun, and tens of thousands of refugees were flooding into Tunisia (which, wonderfully, had welcomed them with open arms, providing housing and resources), the situation had grown more complicated. According to the press and the government, some of the Libyans were bringing weapons into the country with them — weapons stashes had been found in nearby caves. And, alas, on the route to the Grand Erg from Gabes, an Al Qaeda plot had been foiled, with more evidence of Al Qaeda presence being found in the region. (Both Tunisia and Morocco had remained almost Al Qaeda-free until recently, this was all sad news, although it still seemed divorced from the citizen’s everyday reality. Tunisians, especially, seemed casually or privately religious on the whole.)

We realized that it might not be the best thing to drive through the desert countryside, already a tricky operation, without a guide. So we switched plans and headed to tourist center Douz, where once busloads of tourists unloaded to ride camels and 4x4s into the scrubby surroundings, but which was now slowly but valiantly weathering the almost complete lack of tourist traffic since the revolution.

(First, it’s kind of gross that thousands of package tours cancelled now that there was no dictator, although people on package tours seem like the most vulnerable to feelings of uncertainty. Secondly, it was pretty inspiring to see people who were slowly slipping into poverty due to lack of income hold their heads up because they had won freedom — and remain positive that once things had settled down, people would come back. We heard that again and again.)   

So, swallowing my environmental eeks, we chartered a 4×4 to drive us over the dunes (after we had passed any cryptobiotic hotspots) to the hot springs oasis of Ksar Ghilane in the Grand Erg Oriental sand sea, which I probably don’t need to mention was aaaaah-mazing.

We rode camels named Caramel and Ghaniya (“pretty girl”) through a halcyon sunset into a full moon. And then it rained! In the freakin’ Sahara! Awesome.

We were, as usual, the only tourists there (and devoured delectable chicken tagine in an empty, cavernous mess hall right out of The Shining: camel-riding makes you ravenous!). As we were as well at our next stop, mountainous Matmata, the famous “trogolodyte” Sand People/ Mos Eisley Cantina town from Star Wars. I think that’s right — don’t kill me Star Wars nerds. There things, however, took another unexpectedly sinister turn.

Matmata is one of the biggest tourist draws in Southern Tunisia, thanks to the whole Skywalker connection. We rode in bumpily aboard a louage, the shared minivan taxis that are the main means of transport in these remote regions. But as we approached we saw smoke — and a tour bus, the only one of that week we later heard, rapidly retreating. As we entered the town center, the smoke grew overwhelming. A large group of men were burning tires in front of the government outpost. We were told that a govenment official was supposed to arrive from the capital that morning with news of a jobs program, but he never materialized. Out here the unemployment rate is around 70-80 percent, so this was a big deal (even though driving away the few tourists seemed like a bad idea.)

We managed to stay the night in one of the sunken, white-washed, fantasy-come-true underground trogolodyte dwellings, mingle with the locals, and stuff ourselves with kousksi bil djaj (chicken couscous), shakshouka (eggs poached with tomatoes, peppers, and tumeric) and makrouth — sweet, date-filled pastries native to the city of Kairoun.

The next morning, though, protesters had blocked the highway and were burning more tires. 

With no means of transportation, we started hiking the 12 kilometers to the next biggest city — luckily the day was overcast, this was still the Sahara after all! A nice man in a truck with government plates stopped to give us a ride, but as we rounded a large curve we hit another roadblock. A gang of young men from a nearby mountain town were standing ominously behind rocks piled on the road, makeshift weapons of former highway signs in their hands. As we slowly approached, they silently surrounded the truck.

“Uh oh,” I telegraphed to Hunky Beau, “I’ve seen this movie, and it doesn’t end well.” And then, “Well, at least a couple of them are hot.”

The guy giving us a ride backed slowly out and we retreated while he made a few calls. We went back to Matmata, our hearts sinking because the situation was getting heavier there as well. We waited a couple of stomach-wrenching hours on a bend outside of town, wondering what to do, at least enjoying the clifftop views. Lo and behold, our guardian angel in the truck returned with two hardcore, seasoned military men aboard (one of them a thick-faced number who looked like he saw a lot of torture under the old regime — and he wasn’t on the receiving end). We quickly squeezed in. As soon as we got back to the roadblock, the army dudes leapt out of the truck and charged the gang, bellowing and waving their arms.

“That’s the way to do it,” I thought, watching through laced fingers. “Barge the fuck right in.” There was a scuffle, one of the kids tried to grab an officer’s gun, weapons were hectically raised, but the kids eventually backed off after getting to vent a bit, and we charged through. Government escort? I’d never been so happy to have one. And all to help two complete strangers make it to their next vacation stop. Tunisia, I love ya.

But yeah, frustration out there is growing. When we eventually made it back to Douz, we had one of the best meals of my life. Finally, we found a great bowl of Ojja, the egg stew cooked with merguez sausages, served by the wonderful women who run Restaurant Chez Magic —  it really was a house of sausage stew magic!

Final destination: Djerba island, the legendary “Land of the Lotus Eaters.” Probably beautiful in its normal, sunny, sparkling blue Mediterranean state. Racked by magnificent storms when we were there. No Tunisian martinis at the beach for me.

No problem, though — there was plenty to enjoy, including one of Tunisia’s most bewitching specialties: brik. I know that there was a lot of other stuff involved, but if ol’ Odysseus and his Greek crew had trouble leaving this isle behind on their quest to return home, I’m pretty sure brik was involved.

Imagine, if you will, a thin-skinned pastry, stuffed with mashed potatoes, tuna, capers, parsley, olives, chopped onion, and harissa folded into a triangle and lightly deep-fried. But wait! Before the pastry is folded, and egg is gently broken into it, so that when your fork pierces the pastry skin, the yolk gently breaks and oozes out like a swoosh of golden flavor. I am sorry my vegan friends! Magnificent, and the place to get them is called Bric Belgacem in Houmt Souk, the capital, on January 14, 2011 Street (named after the date of the dictator Ben Ali stepped down). Gaaah, I want one.    

We had come to Djerba, like supposedly tens of thousands of other pilgrims, for the huge annual Lag B’Omer festival at the ancient synagogue of El Ghriba, in one of Northern Africa’s last remaining Jewish communities. Yep, on this small island, Jew and Muslim live side by side in peace — we’d unfortunately seen a dismaying share of anti-Semitism (not just anti-Israelism) on our journey in the form of graffiti, alas. We felt bouyant to be a part of this giant celebration.

And sure, in 2002 Al Qaeda had tried to blow up El Ghriba, which holds possibly the world’s oldest Torah (paraded through the streets during the festival). A truck bomb had killed 21. But that was long enough ago not to frighten people away, right?

Not really. Spooked by the revolution and the turmoil just a few kilometers away in Libya (a flood of Libyan refugees was engulfing the island: there were more Libyan license plates than Tunisian ones), so many tourists had cancelled their pilgrimage that the celebration itself was cancelled. And boy, was it cancelled. When we showed up at the ornately-decorated, marvelously Moorish-style synagogue, there were just five old men praying, a father-daughter pair from Kansas (who had just crossed dangerous Southern Algeria for the heck of it) and the effervescent Zoey, a middle-aged Englishwoman who was receiving text messages from God. Let’s let her finish out this account:

“I woke up one day at my home in Norwich one day and I heard God telling me to drive to Israel.” She looked me in the eyes, completely calmly. “So I loaded up my camper and began to drive, trusting him to provide — and he has, oh how has. I made it to Libya and I asked God how was I going to get in. And you know what? He opened the borders for me, just opened them right up so I could drive through. As I was driving toward the border post, the rebels captured it, peacefully, and in the confusion I just drove. I met the rebels and slept in the mountains with them, until it was time to go. I drove on to Benghazi” — she was in a station wagon towing a trailer with a Jesus fish on the bumper — “where God taught me to accept my fear of being bombed, as bombs rained down all around me. I can tell you that was something.

“Checkpoint after checkpoint opened up before me. Sometimes they would search my car, but I had a Koran, and when they saw I had the Word of God with me they let me through. Once when danger approached, I received a text to avoid a certain area. Then finally, I was stopped and they ransacked my trailer. They tried to ransack me as well, but God put a stop to that! I was blindfolded and sent to a prison in Tripoli for a week. They ended up deporting me, and so I’m waiting here at the border until God tells me to try again. Really, you just need to trust sometimes. I can see that you’ll be hearing from him today, just by coming here.

“Sometimes,” she continued, “we have to do whatever crazy thing our heart tells us we should do, and call it belief.”

And with that, she went to drop a harboiled egg in an ancient well, which is the tradition at such occasions.

The taxi strike

It’s notoriously hard to organize cab drivers to do anything. They’re all independent sorts, and they’re split among 34 different companies. Some are permit holders, which makes them the landed gentry of the business; some are serfs who have to pay high fees to lease permits. All of them get paid only for days that they work; there is no vacation time or sick pay in the industry. So the idea that there will actually be a citywide tax strike Aug. 2 seems a bit farfetched.


On the other hand, if enough of the drivers got together, and if even 3 or 4 out of every 10 cabs sat idle, it would make a huge statement. For better or for worse, taxis are a key part of the city’s transportation infrastructure. It’s not Manhattan, which would come to a grinding halt without cabs, but San Francisco — particularly the tourist trade — still depends fairly heavily on a functioning taxi system.


And the drivers are absolutely right to be angry. The “gate” fees — the amount the drivers pay to lease a cab for a shift — go up faster than the fares they collect. Drivers pay for their own gas — and when prices go up, they don’t get to raise the rates. Over the past couple of years, the drivers have been getting squeezed tighter and tighter; it’s no wonder some of them drive at 80 miles an hour to and from the airport. It’s the only way to get enough fares in a shift to make a living.


Now the cabs are required to accept credit cards — and the companies get to charge the drivers a five percent fee on every transaction.


And is anyone surprised that they drivers don’t like having an electronic tracking system follow them around?


Part of what’s going on — let’s be honest — is that the industry is shifting away from cash. When drivers earn only cash, and there’s no way to track how much they’ve driven or how many fares they’ve collected, it’s easier for them to be a little more, shall we say, creative about what they report to the IRS. (The IRS, of course, likes to crack down on cab drivers, waiters and freelance writers, who generally make very little money, while allowing General Electric to pay no taxes at all.)


But if you take away the cash, charge credit-card fees and don’t account for the price of gas, you’re going to get an industry with fewer experienced drivers (nobody can do it for very long), more reckless driving and more scams.


Sometimes I wonder if anyone who works for the MTA has ever driven a cab. Might be an enlightening experience.

I’m on the side of the taxi drivers who held that noisy demonstration at City Hall. The folks who drive taxis get screwed in so many ways — the gate fees (the price of leasing a cab for a shift) go up faster than the fares the drivers can charge. Gas (which comes out of the drivers’ pockets) goes up even faster. And now they’re getting dinged for credit-card fees (even though by law they’re supposed to take credit cards). Add it all up, and the drivers are losing thousands of dollars a year — and they weren’t making all that much in the first place.


Wonder why drivers are bombing along 101 at 80 miles an hour from SFO to the city? The less time they spend on a fare the more fares they can take. It’s dangerous and the drivers don’t like it, but if you have to make a living and the city and the cab companies keep squeezing every dime out of your pocket, you have to drive like crazy.


I understand why Ross Mirkarimi was pissed at the noise — he’s trying to hold a press conference on education and nobody can hear the kids talking. Bad timing. But still — I’m amazed the drivers aren’t more angry. I’m amazed more of them aren’t calling for a strike. Driving a cab used to be a decent way to make a living (half the freelance writers in San Francisco were cab drivers). Now it’s a nasty grind for a stingy reward (and no helath insurance).


A note to journalists covering this story: Most of the drivers I know hate the word “cabbie.” They’re drivers. Taxi drivers. They’re rather be treated as professionals. 


From the bike lane to the bed, ride like a messenger

Bulging thighs pump, shiny parts glimmer and sweaty bodies pedal between the loins of the city. Is Bike To Work Day getting you all hot and bothered, too? Steer the excitement of the bike lane straight into the bedroom and take style notes from the ultimate ride professionals: bike messengers. 

Not all bike messengers are the same, but one thing remains true for any and all that claim the profession: these people are sex on two wheels. Average bikers are hot, too, but messengers are the porn stars of bike culture. Badass, fast, and cocky seem like fair stereotypes, perfect characteristics for tending to spring urges. Hop on the saddle and get ready to romp and ride with messenger mentality. 

Be brave: Biking in San Francisco can be terrifying. Muni tracks, lazy drivers, and mean taxis are real threats, but bike messengers puff up their chests and let adrenaline take the reins. Get adventurous in the sack and shake your fears of the unknown. If you’ve got a pre-planned route, veer off and take a backroad. Try role playing the part of a sleazy bike mechanic and service your lover’s bod. Remember: the customer is always right!

Be healthy: Biking is real good for the body. All those miles keep your heart in great shape and keep blood flowing to all the right spots. They make drink a lot of beer, but messengers work it all off on their route. Talk about stamina. Get some exercise to make sure your organs are up to speed and can perform at their full potential.

Be eco-sexy: Dependency on fossil fuels isn’t hot. Do as the messengers do and pedal instead of drive. Take a romantic ride or race to a secluded spot with your fuck buddy for a naked picnic. 

Be dirty: Sweat and grime is a consequence of the job. Don’t be afraid to get rough and smelly under the sheets. Who cares. Lick it up. 

Be safe: Some messengers probably think they’re too cool for helmets, but no penis is too cool for a condom. Unless you really know the road, it’s always better to be cautious and avoid running your tires through a muddy pothole or STD.

Be prepared: Messenger bags are big for a reason: you can fit all kinds of fun party favors in there. Booze, toys, lube, Advil, kneepads, clean underwear, and anything you could ever need can fit into one of those back sacks. Stock up your stash at home, in the car, the office, your purse, and wherever else you might want some spontaneous spunk.

NY Export: Opus Jazz — where dancers get to be themselves

The empty, Depression-era McCarren Park Pool in Brooklyn was, until 2009, a hip venue packed with vibrant twenty-somethings for concerts and summer “pool parties” alike. It’s also appropriately the location for the opening dance scene in NY Export: Opus Jazz, a film celebrating youthful exuberance, during which, fresh-faced New York City Ballet members in sneakers and street clothes perform the original 1958 Jerome Robbins choreography from the ballet of the same name. Exuding vigor and cool, the film, conceived by New York City Ballet soloists Ellen Bar and Sean Suozzi, marks the first return of Robbins’ choreography to the streets of New York since West Side Story. NY Export: Opus Jazz made its San Francisco premiere on Fri./25 at the Ninth Street Independent Film Center as part of the San Francisco Dance Film Festival, directed by Greta Schoenberg.

During the first movement, a linked chain of dancers, captured from above, curves into a semi-circle on top of peeling painted swim lanes. The dancers sway, snap their fingers and throw high kicks under the arch of crumbling brick that frames the pool. The next movement of Robbins’ dance emerges when four men and the sizzling Georgina Pazcoguin tear into Richard Prince’s jazz score in an abandoned parking garage. Leaping to their stomachs and sliding on the cement, the men appear smaller than the statuesque female standing in the foreground of certain camera shots, adding to Pazcouguin’s powerful presence. Each dance scene alternates with footage of city life (traveling on a train, gathering at a diner), thus incorporating the soundscape of Manhattan’s taxis and horns.

As the whole ensemble gathers at a school gym, sneakers squeak on the shellacked wood floor and dancers take turns curling their hands into fists and thrusting the pelvis. Arial shots capture the colorful formations as dancers weave between each other on the basketball court. Men playfully shimmy and quick flashes of partnering send dancers into the air. The performers get to be themselves in this film: both dancers and city dwellers, with Robbins’ still-relevant choreography as the vehicle for expressing youthful vibrancy.

Later, Craig Hall and Rachel Rutherford perform the seductive duet during sunset on Manhattan’s Highline, their tension-filled embrace revealing a sense of yearning. With all of the film’s dance set in abandoned surroundings, including the final movement performed onstage at an empty theater, NY Export: Opus Jazz suggests that the dancers truly perform for the joy of themselves and each other, rather than any outside audience. The resulting most ravishing spirit is addictive – that of being young and alive in the Big Apple.

JANE BIRKIN

Di Doo Dah

(Light in the Attic)

Arriving in the wake of Light in the Attic’s reissue of the masterful L’Histoire de Melody Nelson, this, Birkin’s first proper — if such a word can be applied to anything involving Serge Gainsbourg — solo album, is a series of light delights. Jean-Claude Vannier trades his characteristic dark orchestration for a string sound that is agile and brighter. On the title track, Birkin revels — in a melancholy way — in her tomboyish characteristics, setting the stage for more pun-filled escapades in androgynous amorousness. Elsewhere, she’s a hitchhiker, a sidewalk cruiser, a hotel trick, a girl on a motorcycle, and other fantasy figurines. The most audacious song is “Les capotes anglaises,” which begins with her blowing up condoms and letting them float off a balcony. The special treat is “Le décadanse,” not so much a failed attempt at creating a dance craze as a successful erotic mockery of dance crazes. There, Gainsbourg appears for another classic duet.

 

DÂM-FUNK

Adolescent Funk

(Stones Throw)

The album’s name is apt, as these tracks, recorded between 1988 and 1992, capture Dâm-Funk’s sound and outlook in a teenage stage of sonic bumptiousness and lyrical lustiness. The content is spelled out in the titles: songs like “I Like Your Big Azz (Girl),” “Sexy Lady,” and “When I’m With U I Think of Her,” are a world away from the mystic leanings of more recent Dâm-Funk tracks like “Mirrors.” Equally direct are the album’s musings on existence, such as “I Love My Life.” The sound owes a debt to — or is a youthful outgrowth of — the early 1980s electro funk of Prince, Mandre, and others. Dâm-Funk has been honing his use of analog keyboards for a long time — when it comes to Korgs and Casios, he’s no new kid on the block, though he was back when these songs were captured on tape. The homecoming-dance cover art, selected by Peanut Butter Wolf from Dâm’s photo albums, captures the vintage feel perfectly.

 

THE FLYING LIZARDS

The Secret Dub Life of the Flying Lizards

(Staubgold)

Flying Lizards are best known for creating possibly the cheapest British chart-topper in history, a pots-and-pans 1979 cover of “Money (That’s What I Want),” distinguished by Deborah Evans’ hilarious deadpan vocal. As the title hints, Evans isn’t present on The Secret Dub Life of the Flying Lizards, nor are any other traditional vocalists — instead, main Lizard David Cunningham remixes 1978 source material by Jah Lloyd. The catch was that Cunningham only had a mono master tape to work with, rather than the plethora of tracks usually associated with dub. A lost gem from the early days of reggae-punk fusions and collisions, this album — with loops built from tape-splicing — reveals the dub underpinnings of Cunningham’s brash and innovative work on “Money.” An irreverent vanguard producer, he uses ping-pong balls to create ricochet effects on one track, just as “Money” seems to throw everything but the kitchen sink at listeners.

 

GIRLS

Broken Dreams Club EP

(True Panther Sounds)

One of the things that makes Girls so special is Christopher Owens’ ability to write so directly about the unavoidable aspects of life without falling into cliché. So it is on “Heartbreaker,” which begins with the observation, “When I look in the mirror/ I’m not as young as I used to be/ I’m not quite as beautiful as when you were next to me.” A newer addition to Girls’ nascent greatness, as displayed on this six-song collection, is their facility at traversing various genres while always sounding like themselves. The reggae and early rock ‘n’ roll fusion “Oh So Fortunate One,” the bossa nova touches of “Heartbreaker,” and the country lament of the superb title track (complete with pedal steel) sound like … Girls. While the sonic palette shifts from song to song — and sometimes within them — more than one composition evokes the anthemic balladry of their 2009 debut album’s “Hellhole Ratrace.” That’s no small achievement. The outlook, though, is less hopeful and more disillusioned. Who knows what the future holds.

 

GOLD PANDA

Lucky Shiner

(Ghostly International)

There should probably be a moratorium placed on the use of the word panda in group names, but the man known as Gold Panda can be forgiven, based on the sheer zinging energy of this album, which has nothing in common with any Beach Boys-flavored Animal Collective endeavors. One of Gold Panda’s trademarks is a sharply-edited, sped-up approach to vocal samples that makes Kanye West’s sound like screw. Instrumental tracks such as “Vanilla Minus,” “Snow & Taxis,” and the incandescent “Marriage” call the crackling warmth of the Field to mind, but their energy is more hyper, their outlook much more colorful. “Same Dream China” takes the glassy percussion of Pantha Du Prince’s “Stick to My Side” into out there realms — it’s one of a few tracks that maneuvers across a high wire just above exotica and Orientalism. A late contender for techno album of the year.

 

THE MANTLES

San Francisco’s the Mantles deliver great straightforward rock ‘n’ roll. Dressed in a cover by local artist Michelle Blade, this EP picks up where their debut album left off, as guitarist-singer Michael Olivares leads the charge with vocals that somehow manage to sneer and snarl and seem amiable at the same time. “Situations” is actually kind of harsh, taking a scenester or gold-digger to task for his or her shallow and failure-fated state of being. “Lily Never Married” is more reflective, a portrait of a spinster that opens into thoughts about family within a changing world. “Waiting Out the Storm” finds the group trying on its epic journey boots, and they fit just fine.

The Effective Disconnect

A disturbing subject yields mournful tone poems on this album by Stars of the Lid’s McBride, which collects elements of his soundtrack for Vanishing of the Bees, a 2009 documentary on colony collapse disorder. (Mercifully, voice over by Ellen Page is left off the album.) There’s no flight-of-the-bumblebee whimsy in McBride’s musical testimony to the spirit of the beehive. In the liner notes, he writes that filmmakers George Langworthy and Maryam Henein suggested he focus on “the gloriousness of the bees, the endurance and hardships of traditional beekeepers, pesticides, and the holistic nature of non-industrial agriculture.” These elements aren’t always clearly distinguished, but they are present in a manner that avoids cliché.

 

ARTHUR RUSSELL AND THE FLYING HEARTS FEATURING ALLEN GINSBERG

Ballad of the Lights

“Ballad of the Lights” was performed by a friend at the late Arthur Russell’s funeral, which is as strong a proof as any that it is an important entry within his vast and diverse songbook. This two-song 10-inch vinyl release couples it with another recording from Russell’s many studio collaborations with Allen Ginsberg. Ginsberg’s recitals within “Ballad of the Lights” almost come off superfluous, except that they set the glory of the song’s resurrection-like structure in greater relief. The B-side, “Pacific High Studio Mantras,” is a Buddhist chant accompanied by instrumentation, and perhaps not intended for commercial release. (Ginsberg himself hinged back and forth about whether it should presented in this fashion.) Bob Dylan even figured briefly within Ginsberg’s and Russell’s endeavors, but with so few of them available, it’s hard to discern whether “Ballad of the Lights” is their best work. That it’s pretty great is clear, even if coupled with portraits by Archer Prewitt that play into the more cloying aspects of viewing artists as icons.

It’s no surprise that the debut album by Bay Area musician Luis Vasquez is dark and densely claustrophobic — nor is it a surprise that it’s excellent. It kicks off with one highlight from his earlier EPs, “Breathe the Fire,” where his whispered vocal — dancing over doom-laden bass and guitar worthy of Pornography-era Cure — manifests maximum sinuous menace. The death dance of “Circles” is more Sister of Mercy-like, but really, Vasquez transcends well-known goth and more obscure dark wave poses and influences through sheer intensity of focus. “Sewer Sickness” might be the album’s darkest and most compelling black pit, as Vasquez’s susurrant vocals take on the quality of a malevolent primal incantation.

 

SOLAR BEARS

She Was Coloured In

(Planet Mu)

Like Gold Panda, Solar Bears counter a dodgy name by delivering solid tunes. She Was Coloured In is more melodic than most recordings on Planet Mu. “Children of the Times” mixes Johnny Marr-caliber guitar shimmer with a Vocoder chorus that is sure to evoke comparisons to Air. Likewise, the title composition places Air-y elements up against Aphex Twin-like ambience. Enjoyably ham-fisted prog keyboard flourishes dive in and out of techno terrain on the title track. The chord changes and underpinnings of “Head Supernova” evoke Angelo Badalamenti’s scores for David Lynch. The riddle of Solar Bears is whether all these touchstones or influences add up to an act with its own identity or — perhaps no less an achievement in 2010 — a generically beautiful album.

When an excellent songwriter disappears, his or her voice remains. There is proof of this in the recent issuing of Connie Converse’s priceless previously-private recordings, and now in this reissue of the 1969 debut album by Jim Sullivan, a ten-song collection that fuses orchestral ornamentation and plainspoken brevity. Sullivan vanished into the New Mexico desert one day in 1975, but his musical legacy is being revived, and rightfully so, as the best moments here are reminiscent of better-known contemporaries such as Fred Neil and Tim Hardin. All the doomed young men: there’s something eerie about the funereal string intro of the opening track “Jerome,” yet Sullivan’s music also possesses vitality and good cheer. Best of all is “UFO,” a graceful piece of baroque pop (and quintessential example of a California paranormal mindset), adorned with echo-laden effects that Malibu kinfolk and relative survivor Linda Perhacs might appreciate.

Golden Haze EP

Captured Tracks is home to some of the most beautiful guitar sounds being made today, thanks to Beach Fossils and this group, who see no shame in sheer ’80s-ness. Wild Nothing hail from California, but England meets Australia (and gets along with it better than usual) on “Your Rabbit Feet,” as Slowdive-gone-fast guitar radiates around a vocal that’s equal parts Morrissey and Robert Forster in its offhand debonair delivery. “Take Me In” has another immediate, whirligig guitar melody, and a chorus as big as 100,000 violins. Gorgeous stuff.

Cab drivers sue over medallion sales

Five cab drivers have filed a lawsuit against the San Francisco Municipal Transportation Agency, arguing that the agency’s sale of taxi permits should legally be considered a tax and that the agency’s so-called Taxi Medallion Sales Pilot Program is invalid without the approval of two-thirds of the voters.

The pilot program was put in place in part to help close the city’s $483 million dollar deficit.

San Francisco taxi drivers need permits, called medallions, to place a vehicle in operation as a cab. Medallion owners can lease the permits to other drivers when they’re not in the car. But it isn’t that easy to get a medallion; only a limited number are available.

Before the Pilot Program was initiated on February 26, taxi drivers who met eligibility requirements to receive a medallion (including a full-time driving requirement) had to put their names on a waiting list. The mediallions cost nothing but a modest processing fee — but the average wait time was 15 years and there were 3,200 names on the waiting list before MTA closed it in December of last year.

The pilot program changes who gets priority in receiving a medallion. Essentially, the city’s going to begin selling them off — not necessarily to the people on the top of the list but to people who can afford the set price of  $250,000. As many as 60 medallions will be sold, with 20 percent of the revenuegoing to the city, 15 percent to the MTA and five percent to a fund for driver welfare.

Drivers at the top of the list will get first shot at coming up with a down payment of $12,500, but if they don’t have the cash, others will get a chance.

 The lawsuit, Willaim D. Pallas vs. SFMTA and City and County of San Francisco, states that the pilot program should be abolished on the grounds that the revenue from medallion sales far exceeds the operating costs of the program – and is thus considered a tax – and that this “tax” should have been approved by voters before the program was even implemented.

 “The persons with money, which aren’t most cab drivers, will dominate the cab industry if this program continues,” plaintiff attorney George Surmaitis told the Guardian, “And the people who have put in the work and sweat to obtain a better life will just stay where they are on the waiting list.”

 Deputy City Attorney Wayne Snodgrass didn’t return calls by press time.

According to the MTA pilot program proposal document, the program has its benefits of allowing its drivers who are 70 years or older to retire and sell their medallions, thus increasing public safety.

 Surmaitis isn’t convinced. “It’s a response to the budget cuts and it’s an attempt to raise money very quickly without considering the impact on individuals,” he said.

 The pilot program impacts individuals such as plaintiff Gerson Garcia, who has been a cab driver for 19 years and has been on the wait list for more than 10 years. “We’ve been waiting for like 10 to 15 years to follow the system they have implemented and now they want to change it because the city needs money,” Garcia told us, “I used to be the manager of taxi dispatch at the San Francisco Airport. I gave up that job in 2008 and became a full-time taxi driver because I wanted to qualify for the medallion.”

 The other four plaintiffs in the lawsuit have been taxi drivers for 16 to 29 years and have been on the wait list an average of 13 years, with most of them turning down other job opportunities and hoping that the extra income from receiving a medallion would help them in retirement. None of these taxi drivers can afford to pay for a medallion and years of waiting will come to naught if the Pilot Program continues.

 The city filed its answer to the lawsuit on July 21, denying the allegations. The plaintiffs in the case plan to have a writ asking the court to put a halt on the sale of medallions sometime before medallion sales are scheduled to start on August 3.

Democratizing the streets

It’s hard to keep up with all the changes occurring on the streets of San Francisco, where an evolving view of who and what roadways are for cuts across ideological lines. The car is no longer king, dethroned by buses, bikes, pedestrians, and a movement to reclaim the streets as essential public spaces.

Sure, there are still divisive battles now underway over street space and funding, many centered around the San Francisco Municipal Transportation Agency, which has more control over the streets than any other local agency, particularly after the passage of Proposition A in 2007 placed all transportation modes under its purview.

Transit riders, environmentalists, and progressive members of the Board of Supervisors are frustrated that Mayor Gavin Newsom and his appointed SFMTA board members have raised Muni fares and slashed service rather than tapping downtown corporations, property owners, and/or car drivers for more revenue.

Board President David Chiu is leading the effort to reject the latest SFMTA budget and its 10 percent Muni service cut, and he and fellow progressive Sups. David Campos, Eric Mar, and Ross Mirkarimi have been working on SFMTA reform measures for the fall ballot, which need to be introduced by May 18.

But as nasty as those fights might get in the coming weeks, they mask a surprising amount of consensus around a new view of streets. “The mayor has made democratizing the streets one of his major initiatives,” Newsom Press Secretary Tony Winnicker told the Guardian.

And it’s true. Newsom has promoted removing cars from the streets for a few hours at a time through Sunday Streets and his “parklets” in parking spaces, for a few weeks or months at a time through Pavement to Parks, and permanently through Market Street traffic diversions and many projects in the city’s Bicycle Plan, which could finally be removed from a four-year court injunction after a hearing next month.

Even after this long ban on new bike projects, San Francisco has seen the number of regular bicycle commuters double in recent years. Bike to Work Day, this year held on May 13, has become like a civic holiday as almost every elected official pedals to work and traffic surveys from the last two years show bikes outnumbering cars on Market Street during the morning commute.

If it wasn’t for the fiscal crisis gripping this and other California cities, this could be a real kumbaya moment for the streets of San Francisco. Instead, it’s something closer to a moment of truth — when we’ll have to decide whether to put our money and political will into “democratizing the streets.”

 

RECONSIDERING ROADWAYS

After some early clashes between Newsom and progressives on the Board of Supervisors and in the alternative transportation community over a proposal to ban cars from a portion of John F. Kennedy Drive in Golden Gate Park — a polarizing debate that ended in compromise after almost two acrimonious years — there’s been a remarkable harmony over once-controversial changes to the streets.

In fact, the changes have come so fast and furious in the last couple of years that it’s tough to keep track of all the parking spaces turned into miniparks or extended sidewalks, replacement of once-banished benches on Market and other streets, car-free street closures and festivals, and healthy competition with other U.S. cities to offer bike-sharing or other green innovations.

So much is happening in the streets that SF Streetsblog has quickly become a popular, go-to clearinghouse for stories about and discussions of our evolving streets, a role that the San Francisco Bicycle Coalition — itself the largest grassroots group in the city, with more than 11,000 paid members — recently recognized with its Golden Wheel award.

“I think we are at a tipping point. All these little things have been percolating,” said San Francisco Planning Urban Research Association director Gabriel Metcalf, listing examples such as the creative reuse of San Francisco street space by Rebar and other groups (see “Seizing space,” 11/18/09), experiments in New York and other cities to convert traffic lanes to bicycle and pedestrian spaces, a new generation of more forward-thinking traffic engineers and planning professionals working in government, and more aggressive advocacy work by the SFBC, SPUR, and other groups.

“I think it’s all starting to coalesce,” Metcalf said. “Go to 17th and Valencia [streets] and feel what it’s like to have a sidewalk that’s wide enough to be comfortable. Or go ride in the physically separated bike lane on Market Street. Or take your kids to the playground at Hayes Green that used to be a freeway ramp.”

Politically, this is a rare area of almost universal agreement. “This is an issue where this mayor and this board have been very aligned,” Metcalf said. Winnicker, Newsom’s spokesperson, agreed: “The mayor and the board do see this issue very similarly.”

Mirkarimi, a progressive who chairs the Transportation Authority, also agreed that this new way of looking at the streets has been a bright spot in board-mayoral relations. “It is evolving and developing, and that’s a very good thing,” Mirkarimi said.

Both Winnicker and Mirkarimi separately singled out the improvements on Divisidero Street — where the median and sidewalks have been planted with trees and vegetation and some street parking spaces have been turned into designated bicycle parking and outdoor seating — as an example of the new approach.

“It really is a microcosm of an evolving consciousness,” Mirkarimi said of the strip.

Sunday Streets, a series of events when the streets are closed to cars and blossom with life, is an initiative proposed by SFBC and Livable City that has been championed by Newsom and supported by the board as it overcame initial opposition from the business community and some car drivers.

“There is a growing synergy toward connecting the movements that deal with repurposing space that has been used primarily for automobiles,” Sunday Streets coordinator Susan King told us.

Newsom has cast the greening initiatives as simply common sense uses of space and low-cost ways of improving the city. “A lot of what the mayor and the board have disagreements on, some of that is ideological,” Winnicker said. “But streets, parks, medians, and green spaces, they are not ideological.”

Maybe not, but where the rubber is starting to meet the road is on how to fund this shift, particularly when it comes to transit services that aren’t cheap — and to Newsom’s seemingly ideological aversion to new taxes or charges on motorists.

“We’re completely aligned when it comes to the Bike Plan and testing different things as far as our streets, but that all changes with the MTA budget,” said board President David Chiu, who is leading the charge to reject the budget because of its deep Muni service cuts. “Progressives are focused on the plight of everyday people who can’t afford to drive and park a car and have to rely on Muni. So it’s a question of on whose back will you balance the MTA budget.”

 

WHOSE STREETS?

The MTA governs San Francisco’s streets, from deciding how their space is allocated to who pays for their upkeep. The agency runs Muni, sets and administers parking policies, regulates taxis, approves bicycle-related improvements, and tries to protect pedestrians.

So when the mayoral-appointed MTA Board of Directors last month approved a budget that cuts Muni service by 10 percent without sharing the pain with motorists or pursuing significant new revenue sources — in defiance of pleas by the public and progressive supervisors over the last 18 months — it triggered a real street fight.

The Budget and Finance Committee will begin taking up the MTA budget May 12. And progressive supervisors, frustrated at having to replay this fight for a second year in a row, are pursuing a variety of MTA reforms for the November ballot, which must be submitted by May 18.

“We’re going to have a very serious discussion about MTA reform,” Chiu said, adding, “I expect there to be a very robust discussion about the MTA and balancing that budget on the backs of transit riders.”

Among the reforms being discussed are shared appointments between the mayor and board, greater ability for the board to reject individual initiatives rather than just the whole budget, changes to Muni work rules and compensation, and revenue measures like a local surcharge on vehicle license fees or a downtown transit assessment district.

Last week Chiu met with Newsom on the MTA budget issue and didn’t come away hopeful that there will be a collaborative solution such as last year’s compromise. But Chiu said he and other supervisors were committed to holding the line on Muni service cuts.

“I think the MTA needs to get more creative. We have to make sure the MTA isn’t being used as an ATM with these work orders,” Chiu said, referring to the $65 million the MTA pays to the Police Department and other agencies every year, a figure that steeply increased after 2007. “My hope is that the MTA board does the right thing and rolls back some of these service reductions.”

Transit riders have been universal in condemning the MTA budget. “The budget is irresponsible and dishonest,” said San Francisco Transit Riders Union project director Dave Snyder. “It reveals the hypocrisy in the mayor’s stated environmental commitments. This action will cut public transit permanently and that’s irresponsible.”

But the Mayor’s Office blames declining state funding and says the MTA had no choice. “It’s an economic reality. None of us want service reductions, but show us the money,” Winnicker said.

That’s precisely what the progressive supervisors are trying to do by exploring several revenue measures for the November ballot. But they say Newsom’s lack of leadership on the issue has made that difficult, particularly given the two-third vote requirement.

“There’s been a real failure of leadership by Gavin Newsom,” Mirkarimi said.

Newsom addressed the issue in December as he, Mirkarimi, and other city officials and bicycle advocates helped create the city’s first green “bike box” and honor the partial lifting of the bike injunction, sounding a message of unity on the issue.

“I can say this is the best relationship we’ve had for years with the advocacy community, with the Bicycle Coalition. We’ve begun to strike a nice balance where this is not about cars versus bikes. This is about cars and bikes and pedestrians cohabitating in a different mindset,” Newsom said.

Yet afterward, during an impromptu press conference, Newsom spoke with disdain about those who argued that improving the streets and maintaining Muni service during hard economic times requires money, and Newsom has been the biggest impediment to finding new revenue sources.

“Everyone is just so aggressive on trying to raise revenue. We’ve been increasing the cost of going on Muni the last few years. I think people need to consider that,” Newsom said. “We’ve increased the cost of parking tickets, increased the cost of using a parking meter, and we’ve raised the fares. It’s important to remind people of that. The first answer to every question shouldn’t be, OK, we’re going to tax people more or increase their costs.

“You have to be careful about that,” he continued. “So my answer to your question is two-fold. We’re going to look at revenue, but not necessarily tax increases. We’re going to look at revenue, but not necessarily fine increases. We’re going to look at revenue, but not necessarily parking meter increases. We’re going to look at new strategies.”

Yet that was six months ago, and with the exception of grudgingly agreeing to allow a small pilot program in a few commercial corridors to eliminate free parking in metered spots on Sunday, Newsom still hasn’t proposed any new revenue options.

“The voters aren’t receptive to new taxes now,” Winnicker said last week. Mirkarimi doesn’t necessarily agree, citing polling data showing that voters in San Francisco may be open to the VLF surcharge, if we can muster the same kind of political will we’re applying to other street questions.

“It polls well, even in a climate when taxation scares people,” Mirkarimi said.

 

BIKING IS BACK

It was almost four years ago that a judge stuck down the San Francisco Bicycle Plan, ruling that it should have been subjected to a full-blown environmental impact report (EIR) and ordering an injunction against any projects in the plan.

That EIR was completed and certified by the city last year, but the same anti-bike duo who originally sued to stop the plan again challenged it as inadequate. The case will finally be heard June 22, with a ruling on lifting the injunction expected within a month.

“The San Francisco Bicycle Plan project eliminates 56 traffic lanes and more than 2,000 parking spaces on city streets,” attorney Mary Miles wrote in her April 23 brief challenging the plan. “According to City’s EIR, the project will cause ‘significant unavoidable impacts’ on traffic, transit, and loading; degrade level of service to unacceptable levels at many major intersections; and cause delays of more than six minutes per street segment to many bus lines. The EIR admits that the “near-term” parts of the project alone will have 89 significant impacts of traffic, transit, and loading but fails to mitigate or offer feasible alternatives to each of these impacts.”

Yet for all that, elected officials in San Francisco are nearly unanimous in their support for the plan, signaling how far San Francisco has come in viewing the streets as more than just conduits for cars.

City officials deny that the bike plan is legally inadequate and they may quibble with a few of the details Miles cites, but they basically agree with her main point. The plan will take away parking spaces and it will slow traffic in some areas. But they also say those are acceptable trade-offs for facilitating safe urban bicycling.

The city’s main overriding consideration is that we must do more to get people out of their cars, for reasons ranging from traffic congestion to global warming. City Attorney’s Office spokesperson Matt Dorsey said that it’s absurd that the state’s main environmental law has been used to hinder progress toward the most environmentally beneficial and efficient transportation option.

“We have to stop solving for cars, and that’s an objective shared by the Board of Supervisors, and other cities, and the mayor as well,” Dorsey said.

Even anti-bike activist Rob Anderson, who brought the lawsuit challenging the bike plan, admits the City Hall has united around this plan to facilitate bicycling even if it means taking space from automobiles, although he believes that it’s a misguided effort.

“It’s a leap of faith they’re making here that this will be good for the city,” Anderson told us. “This is a complicated legal argument, and I don’t think the city has made the case.”

A judge will decide that question following the June 22 hearing. But whatever way that legal case is decided, it’s clear that San Francisco has already changed its view of its streets and other once-marginalized transportation choices like the bicycle.

Even the local business community has benefited from this new sensibility, with bicycle shops thriving around San Francisco and local bike messenger bag companies Timbuk2 and Rickshaw Bags experiencing rapid growth thanks to a doubling of the number of regular bicyclists in recent years.

“That’s who we’re aiming at, people who bike every day and make bikes a central part of their lives,” said Mike Waffenfels, CEO of Timbuk2, which in February moved into a larger location to handle it’s growth. “It’s about a lifestyle.”

For urban planners and advocates, it’s about making the streets of San Francisco work for everyone. As Metcalf said, “People need to be able to get where they’re going without a car.”

Just “Duck”-y

CULT FILM STAR Although the mainstream Hollywood press and audiences at large may not have flocked to theaters in support of the initial release of Howard the Duck in 1986, a core group of devoted fans and successive generations of viewers have elevated the film to cult classic status, resulting in a long-awaited special edition DVD release last year.

Ed Gale, the actor who stepped inside the Howard costume and helped bring the character to life, will be appearing at this weekend’s WonderCon, the largest comic book and pop culture convention in Northern California, to meet fans and sign autographs (look for him at booth M19 in the Autograph Area, room 105).

In what was his first Hollywood role (it was actually the first movie he even auditioned for), Gale used highly energetic body language to convey the emotions of the diminutive yet daring duck. That high level of energy expenditure took a physical toll on the actor — and the restrictions presented by the full-body costume made even simple things, such as eating, very difficult.

“When it became apparent I was losing too much weight too fast — I lost 11 pounds in 30 days — they had to give me straws with protein shakes, or they’d drop M&M’s down my beak,” Gale remembered, speaking over the phone from Los Angeles.

Filmed largely in the Bay Area (the characters visit the California Academy of Sciences, take taxis in the Sunset District, and fly over the rooftops of downtown Petaluma), Howard the Duck had the backing of George Lucas as executive producer — which is one reason Gale suspects the movie was treated so harshly by critics when it appeared to be a financial failure.

“We as a society love to build people up and then tear them down, apparently they felt it was time to tear George Lucas down. But the power of the people has proved them wrong.”

Gale, who has also appeared in films like Child’s Play (1988) and Spaceballs (1987), along with more recent roles in television including My Name is Earl and Bones, says Howard is still the most popular character he has played. He’s looking forward to returning to San Francisco.

“The adage that my manager told me was, ‘If you’re going to be good, be the best. If you’re going to be bad, be the worst, and you’ll never be forgotten.’ And with Howard the Duck and all the great fans, that has never been more true,” he said. “I definitely want to meet a whole new bunch of friends in the city where it all began.” (Sean McCourt)

The battle for the forgotten district

This November, when voters in District 10 — the largest, sunniest, and most diverse of the city’s 11 supervisorial districts — replace termed out Sup. Sophie Maxwell, they’ll be making a selection that could have pivotal implications for the entire city.

That’s because the next supervisor from southeast San Francisco inherits a district that is home to some of the city’s biggest environmental and public health challenges, as well as the most potential for development that will determine what kind of city San Francisco becomes.

District 10 is where you’ll find the most polluted and most underdeveloped lands in San Francisco, areas that could either be transformed into models of a sustainability or, in the words of Tony Kelly, the president of Potrero Boosters Neighborhood Association, “be turned into a toxic Foster City.”

District 10 is where the slaughterhouses, tanneries, and glue factories set up shop and used the bay as a dumping ground. It’s where the smokestacks of coal and oil fired power plants polluted the air. It’s where the Navy filled the Bay, built a shipyard at Hunters Point and loaded parts of the first atomic bomb onto the USS Indianapolis in 1945.

District 10 is where the bottom fell out of this industrial economy in 1974, when the Navy left, taking with it people’s jobs, pay, and hopes for a home of their own and a better future, particularly for what was then a predominantly African American population.

And District 10 is ground zero for plans that will triple the population and double the number of homes — homes that likely will only be “affordable” to Google executives and retirees from Marin, forever changing the face of San Francisco’s southeast sector. Critics fear that will accelerate what has been a steady exodus of black residents, replaced by megadeveloper Lennar’s vision for a new D10.

It’s against this dark history and difficult present that a wide open field of more than a dozen candidates are vying to replace Maxwell, who came to power in 2000 and has had a mixed voting record in her decade on the board. Sometimes, Maxwell was the eighth vote that let the progressive majority on the Board override Mayor Gavin Newsom’s veto and pass trailblazing legislation. Other times, she was the swing vote that allowed the moderate minority to carry Newsom’s water.

So, in addition to D10’s many internal challenges, this seat could determine the political balance of power on the Board of Supervisors, placing all the more importance on voters in this long-marginalized part of town.

 

DISTRICT OF DISCONTENT

Eric Smith, a biodiesel activist who has thrown his hat in the D10 ring, says that there is a lot of frustration in the air, and looking at the problems the district is facing, it’s hardly surprising that it has what nearly every candidate agrees is a fractured political culture.

“The Bayview, the Hunters Point Shipyard’s toxic Superfund site, the homicide rate, unemployment, poor public transportation, dwindling services and community resources have made D10 one of the city’s largest melting pots of discontent,” Smith said.

Smith’s words were spoken while the Elections Department was verifying signatures earlier this month on a second failed effort to qualify a petition to recall Maxwell.

Bayview resident and D10 candidate Marie Franklin didn’t support the attempt to recall Maxwell, but she understood it as “a frustration movement.”

“People are sinking in the sand, we’ve already lost so many of them, and they felt Sophie wasn’t doing anything for them,” said Franklin, who praised Maxwell for helping get Franklin’s apartment building complex renovated — a job that was completed 18 months ago, at a cost of $65 million, creating 500 local jobs.

“There are 654 units here, and they were uninhabitable,” Franklin said. “There was black mold, rain falling inside. We had people living worse than Haiti.”

Franklin, who said she is running because she “knows the history,” came here in 1978, when she and her son were living in a car after a fire left them homeless. She said the Bayview was a totally isolated area, barely part of mainstream San Francisco.

“There were no taxis, no services,” she recalled. “Nobody would come here, it was the stigmatized area where no one was accountable to provide services.”

The Bayview — which in some ways is the heart of D-!0 — wasn’t always a black community. But African Americans have been living here for 70 years, dealing with all the racism, denial of services, poverty, and pollution. And it bothers Franklin that 85 percent of the 10,500 homes that Lennar plans to develop won’t be affordable to the elderly, disabled, unemployed and low-income people who currently live in the Bayview.

“We need to preserve the diversity of the community and make sure their issues and information will flow to City Hall,” she said. “You must give the people a handle. If you don’t reach out, they’ll slip. That’s why folks out migrated.

Whoever succeeds Maxwell will be a central player in addressing some very big and dirty issues: the future of the Navy’s radiologically impacted shipyard at Hunters Point, Lennar’s massive redevelopment plan for the Shipyard and Candlestick Point, the polluting power plants, replacement of stinky digesters at the sewage plant, and the SF Hope public lousing rebuild.

There’s also the chance to address violence and crime. James Calloway, a candidate who has long worked in Bay Area schools, told us he believes that education and jobs are part of the keys to rejuvenating the district.

“Job opportunities are not as plentiful in the district,” Calloway said. “When I was a kid, you could walk down Third Street at 2 a.m. Now I wouldn’t walk down it at 9 p.m., and I know the area.”

Calloway is hopeful that the massive redevelopment plan, if done correctly, could start the district’s comeback. “Not a lot of black folks stay here when they have extensive education,” he said. “But it’s not only them. Many were displaced by redevelopment and had no way to go back.”

 

ELECTION UP FOR GRABS

The largest of the city’s 11 electoral districts, D10 is a huge triangular piece of land in the city’s southeast sector that was used as an industrial dumping zone for decades. Today, the district runs from the Giants stadium at AT&T Park to the 49ers stadium at Candlestick Point and encompasses Mission Bay, Potrero Hill, Dogpatch, India Basin, Portola, Little Hollywood, and Visitacion Valley. It’s also crossed by two freeways that isolate it from the rest of the city, and is home to a large number of crumbling housing projects that are in the process of being rebuilt.

Candidate Ed Donaldson grew up in the projects until he was 10 years old, when the Redevelopment Agency kicked his family out in the 1970s. “We landed on our feet, but others weren’t so lucky,” said Donaldson, who works as a housing counseling director at the San Francisco Housing Development Corporation.

“There is a sense that the Bayview and Visitacion Valley have not been included within the San Francisco family,” Donaldson said. “There is a sense of being forgotten.”

In 2007, Donaldson co-founded the Osiris Coalition to tackle the city’s dormant Certificate of Preference program, in which the Redevelopment Agency issued a document to displaced residents and businesses in the 1960s promising that they could return.

He also tried to rescue some 700 foreclosed properties and recycle them as affordable housing stock. And now he is trying to prevent the city from bulldozing seven SF Hope projects without guaranteeing residents that they have right to remain.

In 2007, Mayor Gavin Newsom and Maxwell convened an African American Outmigration Task Force that didn’t get a public hearing about its findings until August 2008. The timing angered some, who questioned why the report’s findings and implications for urban planning weren’t released before June 2008, when the residents of San Francisco voted for the Lennar-led Proposition G, a proposal to build 10,000 market rate homes at one of San Francisco’s last remaining black communities, which Newsom and Maxwell endorsed.

The taskforce didn’t publish its recommendations until the end of 2009, allegedly because of insider squabbling. Meanwhile, gentrification was going on actively, and many blamed Newsom, and by extension Maxwell, for failing to do anything with the group’s findings as D10 residents continued to suffer from high rates of asthma, cancer, unemployment and an ongoing black exodus.

It wasn’t always this way. In the 1940s, the district’s black population exploded when migrants from the south and World War II veterans came to work at the Hunters Point Naval Shipyard. Some moved to Alice Griffith Public Housing complex, or Double Rock, which was built as military housing in 1962. Others relocated to the Bayview when the Redevelopment Agency took over the Fillmore/Western Addition in the ’60s and ’70s as part of a controversial urban renewal effort.

But when the Navy abandoned the shipyard in 1974, unemployment hit the black community hard. Today, hundreds of the city’s lowest income residents live in Alice Griffith’s crumbling units and endure sewage backups, no heat, cloudy drinking water and leaking ceilings, as they wait for the projects to be rebuilt.

“Generations have been trapped in the silo of public housing and cannot get out, because of lack of opportunity and education, so when we legislate, we need to take that into consideration,” said candidate Malia Cohen, whose grandfather came from Texas to work at the shipyard where he met her grandmother, whose family came from New Orleans.

“My grandfather’s father was a longshoreman. He worked with the infamous Leroy King [a commissioner at the city’s Redevelopment Agency] and he has fantastically vivid stories of racism,” said Cohen, who works for the Federal Reserve Bank of San Francisco, previously served on the executive staff of Mayor Gavin Newsom, and has already raised over $18,000 in the D10 race and qualified for public matching funds.

“My family came here to work hard, they lived on Navy road in the projects, and then they bought a house here. My parents were born here, and we were all public schooled,” Cohen recalled as she took me on a tour of D10 that ended up in Visitacion Valley, an increasingly Chinese-American neighborhood that reflects a district-wide trend.

Census data show that by 2000, Asians were the largest racial group in the district (30 percent), followed by blacks (29 percent), whites (26 percent), and Latinos (19 percent). By 2003, according to the California Urban Issues project, the trend continued. Asians were the largest racial group (32 percent), followed by blacks (27 percent), whites (21 percent) and Latinos (17 percent) of the population.

This means that D10 candidates will have to garner support from more than one ethnic group to win. Over a dozen candidates have already filed papers in the race, but so far there is no clear front-runner.

Also frustrating the prognosticators is that fact that D10 has had the lowest voter turnout in the city, so the winner will also depend on who goes to the polls.

D10 candidate Geoffrea Morris, who is the grand daughter of longtime Bayview activist Charlie Walker, has been knocking on doors and participating in voter registration drives.

“We need new blood,” Morris said

Getting elected will be a complicated equation. Although Bayview’s population was 50 percent African American at the time of the 2000 census, it didn’t turn out the vote. In the 2006 election, only 14,000 of the district’s 37,000 registered voters went to the ballot, and 50 percent were from whiter, richer, and more Asian neighborhoods.

“It’s very important to the future of the city that the ethnicity diversity of the board be maintained and that the African American community have representation,” former Board President and current Democratic Party chair Aaron Peskin told the Guardian.

Maxwell recently told the Guardian that she’s not ready to endorse any D10 candidates yet. “I’m waiting for people to have a better understanding of what this community is, what the common thread running through it is, and how to use rank choice voting,” she told us.

The only candidate who currently holds elected office is BART director Lynette Sweet, who had her answers down pat when we reached her by phone, and even used wording that was eerily similar to Maxwell’s words.

“D10 is a pretty diverse district, but there is only one common thread: the need for economic development,” Sweet told me. “That’s true in Potrero Hill, Portola, Dog Patch and the Bayview. It’s the same mantra: a lot of small businesses need help, and the only way to help them is through economic development. In Potrero Hill it’s about land use. In the Bayview, it’s about the shipyard and better transportation and truancies.”

 

THE COMMON THREAD

District 10 is ground zero for the Lennar’s $2.2 billion plan to develop 10,500 market rate condos at the Shipyard and Candlestick Point. The plan will allegedly create thousands of jobs and new parks, deliver on an historic community benefits agreement that labor groups claim is so “lawyered up” that the developer can’t renege on its promises.

The package is framed as the one and only way to revitalize the southeast’s formerly vibrant economic engine. Indeed, any time anyone tries to slow down the process—to take time to thoroughly read the draft EIR and see if it adequately addresses the impacts of this massive urban reengineering project — a chorus of “no delays” starts up, either from residents of the housing projects desperate to see their homes rebuilt, or the labor contractors who hope to get jobs.

“It’s as if the city is playing checkers, while Lennar is playing three-dimensional chess,” Eric Smith observed.

Lennar has stated that it will contribute $711 million to finance this massive project. The remainder will be leveraged by Mello-Roos bonds, state taxes based on the use and size of a property and intended to raise money for needed services, and tax increment financing, which creates funding for projects by borrowing against future property tax revenues.

The conceptual plan won Maxwell’s backing but environmental groups are critical of the draft EIR.

During DEIR hearing, environmentalists questioned the wisdom and the cost of filling the Bay to build a bridge over Yosemite Slough, and building condos on Candlestick Point state recreation area, the only open major open space in the district.

But the city’s Planning Department also has 20,000-30,000 units of housing in its pipeline. This means that if all these plans get approved in the next decade, they’d account for 80 percent of residential development citywide. And D10’s population could triple, further skewing the district’s already shifting demographics.

In other words, D10 as we know it could become nothing more than a historic relic in a few years, and the next supervisor will play a key role in deciding whether that happens. SFHDC’s Ed Donaldson warns that any supervisor who does not understand the complexity of the city’s largest district can expect a similar recall backlash in future.

“There is no one homogenous voice in the community,” Donaldson said. “The grass-roots organizing that brought about the recall effort was a result of a changing political structure in the area, but is not yet on par with other districts in town. We still allow our politics to be controlled from downtown.”

Fellow candidate Eric Smith warns that the issues—and politics—are complex.

“People were emotional, angry, and desperate because they feel no one listens to them,” Smith said. “That’s part of the problem here; they would rather have a supervisor go down swinging for them, rather than watch one seemingly side with Lennar, PG&E and the mayor on issues contrary to their interests. That’s the terrible irony and one of the biggest problems in District 10. Folks are so mad, they’re willing to do whatever it takes to make them feel they have a voice in the outcome, even if it’s potentially worse.”

Smith cited the sequence of events that culminated last year in the Navy dissolving the community-based shipyard Restoration Advisory Board (RAB), which for years has reviewed technical documents and commented on the Navy’s clean-up proposals. But in December, the Navy made its official decision to disband the RAB, citing dysfunctional behavior and off-topic discussions that got in the way.

“Some of the same folks who were frustrated by the process, tried to send a signal to the Navy that they weren’t being heard and for all their well-intentioned efforts got the RAB dissolved,” Smith said. “I truly feel for them, it’s absolutely heartbreaking, but at times, they can be their own worst enemy.”

One of the looming issues about the shipyard is that the land has been polluted and needs to be cleaned. The shipyard contains radioactive debris from ships towed to the shipyard, after a 90-foot wave washed over them during an atomic test gone awry. The Navy burned 610,000 gallons of radioactively contaminated ship fuel at the shipyard, and workers showered on the shipyard, raising concerns that radioactive materials got into the drains and sewers. And questions have been raised about radiological tests on animals at the yard.

 

LEAKS AND FLOODS

It’s not just the shipyard that’s toxic. Even the buildings that were constructed to house workers 50 years ago are a serious mess.

Realtor Diane Wesley Smith, who grew up in public housing projects, took me on a walking tour of Alice Griffith last week to see conditions that tenants will likely have to endure until at least 2014, if the city sticks to its plan to relocate people into a new replacement unit in the same geographical area, if not the exact same site.

What we found was pretty messed up.

“The water sometimes comes out brown and feels like sand. It’s been like that for a year,” one resident said.

“The water is cloudy, the bath tub isn’t working and the sink keeps stopping up,” said another.

A woman named Silvia showed us how the water from the tap in her elderly mother’s kitchen flows out cloudy and then doesn’t settle properly, like foamy beer.

“The roof’s been leaking for years, the sewage backs up, but they just fixed the lights,” Silvia said. A neighbor named Linda was using her oven as a heater.

“The toilet backs up a lot, and my grandson’s been coughing a lot from asthma,” Linda said.

“Roaches is always a problem,” said a woman named Stormi, dressed in black sweats and a black T-shirt that read, “Can’t knock the hustle.”

“They’re trying,” said Stormi, a member of the Alice Griffith Residents Association, as a couple of Housing Authority trucks pulled up to do repairs.

“They promise that you will not have to leave your unit, but if they try to move us down to the waterfront, well, there’s a reason there’s no housing there, and it’s because the land will flood,” Stormi said.

“If we don’t end up at the table, we’ll end up on the menu,” Wesley Smith warned, as she stopped to chat with a group of young men, who were worried they would pushed out of the Alice Griffith rebuild through the criteria being established.

“Fred Blackwell, the executive director of the Redevelopment Agency, assures me that’s not the case, but Alice Griffith is a Housing Authority property, and empty promises have the potential to be great promises provided they are made in writing,” Wesley Smith said as we walked out of the projects and onto the road where a yellow and black sign announced “flooded” next to Candlestick Point park, where Lennar wants to build.

Malia Cohen expressed concern about Hope SF residents, as we drove through the Sunnydale housing project.

“We have to be diligent and mindful that people are not pushed out,” Cohen said, noting the sweeping views at Gleneagles golf course above Sunnydale, and the value of housing for a golf course community. “When public housing gets taken offline, we must work with Redevelopment and the Housing Authority to make sure no one is changing the rules halfway. We have to make sure the talks and walks line up. We need to be equal partners. We cannot be bulldozed by City Hall.”

Geoffrea Morris is a Calworks employee, at the Southeast Community College facility on Oakdale, which was built to mitigate the city’s expansion of the sewage plant in 1987. She cited concerns about the literacy levels of people who live in the 2200 public housing units that cluster D10. “A lot of people in Alice Griffith don’t even know the dates or when it’s going to be reconstructed,” Morris said. “Folks like to be told stuff like that, but the city gives you a stack of papers. Some will read them, but others rely on folks they think are trustworthy. They need stuff in layman’s terms written on one sheet of paper.”

Morris is a fan of the Internet who posted a community survey online, and made sure every housing project got some literature telling people to get informed. She worries about the digital divide in D10:

“A lot of folks don’t have computers and access to important information,” Morris said. “And let’s talk about the way ‘affordable’ is used to trick people.”

Michael Cohen, Newsom’s top economic adviser, recently stated in a memo that over the expected 15-20 year phased build out, Lennar’s Candlestick-Shipyard development would include, “up to 10,500 residential units, about 32 percent of which (3,345) will be offered at below market rates.”

“But 892 units of this ‘affordable category’ will be sold to folks earning $100,000,” Morris said. “So if you subtract 892 units from affordable unit category, you’re back to 25 percent affordable.”

Candidate Kristine Enea, an attorney and a former RAB member, chairs the India Basin Neighborhood Association, which administers a US EPA grant to hire experts to translate the Navy’s cleanup documents into plain English and comment on them She was frustrated by the Navy’s decision to dissolve the RAB.

“The lack of a forum does nothing to bolster the community’s trust in the cleanup or the redevelopment process,” Enea said.

Enea generally supports the Lennar project, but has concerns about whether it will adequately mitigate increased car traffic, or result in commercial development that benefits her neighborhood.

“India basin is a pocket of Hunters Point right along the shoreline,” Enea said. “Right now, we have no shops or restaurants, no ATM, no groceries, nothing beyond one liquor store and a few industrial businesses.

Potrero Boosters president Tony Kelly told us that District 10 residents can think for themselves. “D10 residents don’t need to rely on corporations to solve their problems,” he said.

“Folks in the eastern neighborhoods came up with a better revitalization plan than what the city proposed and community activists managed to close the power plant, after the city said it was impossible,” Kelly recalled.

And there’s no shortage of good ideas.

Kelly suggested that an urban agriculture center could immediately put low-skilled folks to work by erecting greenhouses on unused land. Smith said the industrial zone could be “incredible eco-park made from sustainable sources.

‘D 10 is the dumping ground for everything, including all the city’s waste,” he said. “We could be a shining example, not just for D 10, but the rest of the state.”

The D 10 candidate line up includes Calloway, Cohen, Donaldson, Smith, Enea: civil rights attorney Dewitt Lacy, Morris, Potrero View publisher Steve Moss; District 7 BART director Lynette Sweet, Wesley-Smith. Bill Barnes, who works for Sup. Michela Alioto-Pier, and Linda Richardson, who was appointed to the Human Rights Commission in 2007 by Mayor Newsom, have also expressed interest in the race.

In such a huge field, name identification will play a major role. Sweet is in office, but BART Board is not a high-profile job and won’t give her a huge advantage.

Cohen has a slight edge right now in that she’s raised $18,505, including $500 from former Newsom flak Peter Ragone, making her the first D. 10 candidate to qualify for campaign financing. The oldest of five girls, Cohen recalls how her mother got laid off from her city job as a school-based mental health worker and then rehired, as part of the city’s budget cuts.

“We felt that pinch and the frustrating games that are played out between the leadership and the rank and file,” she said.

Cohen who worked for Newsom in his first term as mayor, but has since left his administration , said she is uncomfortable at being framed as Newsom’s candidate.

“Because I’m not, but I am one of the few candidates who has seen how the mayor and the Board work—and don’t work—together,” she said.

Moss sees the city’s southeast as a “district in transition.” Over coffee at Farley’s in Potrero Hill, he told me that the southeastern neighborhoods could be “launching pads for environmentally sustainable growth.”

“The district’s been in a frozen period for 30 years, But despite the problems, people are deeply committed to and in love with their community.

“This district is the future of San Francisco and its social fabric—the diversity, income –and its problems are leftovers from the city’s industrial age.”

I loved Juliette Tang’s piece on the cult of the hermaphrodite poster. One of the beautiful, sexy things about San Francisco is our collective psychosexual make-up. I’m turned on by the seemingly infinite ways our sexual selves can manifest, inhabit… twist?

On one of those few recent warm nights, I was walking down Polk Street and when ran across this same poster taped to a telephone pole. What drew my attention was the Scotch tape and white out. Each poster had been touched by a human hand. I live near Frontlyne Video (1428 Bush Street. “Speciality” movies. Large TS section. Stop by and say hi), so I stopped by to look at the book: “Cult of the Hermaphrodite Unveiled…is part 2(two) of Master R.J. Daniel’s PATH of the ASTRONOMER/SCRIBE/PRIEST/WARRIOR from “A Private Think Tank” known as the “Almasi Scholars Research and Consulting Organization”, who are “Observers and Trackers in trends in adult entertainment. economics, religion, politics, male-female-family and gender.”

I must confess that I pulled what little sex clout I’ve garnered writing SFBG Sex SF blog, and the the counter guy was cool enough to let me sneak a peek. The truth was revealed to me in crude, meticulous drawings, collage, and Situationist-inspired type-text :

“Hermaphrodites, calling themselves SHE MALES/TRANSEXUALS, travel a NATION-WIDE CIRCUIT of LOVE-MAKING, where they are WORSHIPPED as GODESSES of EROTIC LOVE. LOVE PISTOLS on TOUR Fully LOADED”

Written more like an expose than a story (though it begs to be one), Master Daniel traces the still-influential Cult of the Hermaphrodite to the ancient Phoenician city-states and the sex-cults of King Solomon 6,000 years ago. The affluent male devotees of the cult, known as satyrs, wish to re-establish the erotic link between the god of cunning, swiftness, and commerce (Hermes) with the goddess of love, beauty and raw sexuality (Aphrodite). After his initial thesis, he backs it up with a complex cosmological and numerical system based on astrology, astronomy, pornography and folklore.

Cruising through the Polk district on another rare warm evening, with Diva’s down the block and the TS sex-workers mingling on corners, stepping out of town cars, limos and taxis, even I could see the possibilities of a cult rife with sultry rites lurking in the catacombs. Could Master Daniel be right? Wouldn’t it be fun to make him so?

I’ve seen Master Daniel, and have run across one of his business cards. Call me a freak if you need to, but I love stuff like this. My novel — Knot Frum Hear (2010) — is loosely based on an actual San Franciscan known as James Bond Zero who also printed his own business card. Though there is a 30 year difference, they could be working for the same company, William S. Burroughs CEO.

Master Daniel’s book, which Frontlyne reports has been selling “pretty good,” is copyrighted and with his written permission, I will post more of his actual text and images. Yes, I will be calling him. Is that another story or the same one? We’ll see…

Big changes for cab industry

The San Francisco taxi industry may be headed for a major shakeup that could change the way the city distributes the medallions that allow driver to legally operate cabs.

There’s no formal proposal on the table right now, but over the past few months, the director of the Municipal Transportation Agency’s taxi division, Christine Hayashi, has been meeting with drivers, cab companies and other stakeholders to discuss what could be sweeping changes in Proposition K, the 1978 measure that set the rules for cab permits in San Francisco.

She plans to issue a report on her proposals to the MTA Jan. 5th, but she’s been presenting talking points that give a suggestion of where the proposals might go — and it involves the sticky issue of allowing some medallion holders to sell their city permits for cash.

Prop. K, authored by then-Sup Quentin Kopp, was based on the premise that cab permits are valuable, belong to the city and should only be issued to people who are actually driving taxis. Under the current rules, only active drivers can hold permits, for which they pay a nominal annual fee. The only way to get a permit is to put your name on a list and wait for one of the 1,500 medallions to become available, which happens when a permit holder retires from driving or dies.

The wait is now more than 10 years.

Permits are worth a lot. You not only get to drive a cab, you can least the permit to other drivers when you’re off duty — and since cabs are in use 24 hours a day, the lease revenue alone amounts to about $30,000 a year.
Prop. K put an end to the concentration of ownership in the industry, taking control of the lucrative permits away from the few big companies that dominated the business in the early 1970s. And it ensured that working drivers got the benefits of permits.

It’s also created a complex industry system: Most drivers are independent contractors who lease both vehicles and medallions from cab companies. They pay more than $100 a shift in lease fees — known as “gates” — then pay for their own gas and try to bring in enough fare revenue over the course of a 12-hour shift to cover costs, and keep whatever is left over as their income.

They get no health insurance from the cab companies, no retirement plans, and no disability. The medallion holders do a little better — they get the best shifts, pay lower gates and keep the outside lease income — but they lack benefits, too.

A lot of the drivers like the independent contractor system — the harder they hustle, the more money they make. But once drivers get the valuable medallions, they don’t ever want to relinquish them.

That’s left a potentially dangerous situation: A significant percentage of medallion holders — perhaps as many as a third, by preliminary city estimates — are more than 60 years old, and quite a few are over 70. Some have vision problems. At a certain point, it’s not safe to have them carrying passengers in cabs; that’s not ageism, it’s a basic medical fact. Most transportation systems have mandatory retirement ages; airline pilots typically have to get out of the cockpit at 60.

But the aging medallion holders have gotten used to that $30,000 a year in income, and refuse to retire — because once they stop driving, they have to turn the permit back to the city.

In some places — New York City, for example — cab medallions are sold on the open market, and go for anywhere from $250,000 to more than $500,000. Drivers take out bank loans similar to mortgages to buy the permits, then sell them when they get out of the business. Speculators also buy and sell them, like pork belly futures.
Mayor Gavin Newsom last year suggested a similar system
for San Francisco.

That’s not what Hayashi is suggesting. Both she and MTA spokesperson Judson True told me that it’s too early to talk about a specific set of proposals. But in a taxi town hall meeting she held Dec. 15th, Hayashi put out some talking points that show what could be the outlines of a plan to overhaul the industry.

The goals she outlined are pretty basic — and laudable. Driver quality of life (the better things are for drivers, the better drivers we’ll get), public service and safety, “entry strategy” — that is, who gets medallions and how do you encourage good drivers to stay in the business — and “exit strategy” — how do you deal with drivers who want to, and ought to, retire.

But then it gets tricky.

Hayashi suggested that some percentage of the permits — say, 40 percent, which would be 600 medallions — would be designated as “retirement eligible.” Those medallions could be sold when a driver retires, and the driver could keep most of the money (after a sizable cut goes to the city). Instead of auctions, though, Hayashi wants the city to set the sale price — at a level that drivers could afford. That price would depend in part on what sort of loans local banks and credit unions would be willing to make, and at what rates.

The people currently on the waiting list would have first shot at buying the medallions.

The other thing she talked about was winnowing down the current seniority list. It’s no secret that a lot of the people on the list have been out of the industry for years. Her presentation jokingly talked about getting rid of the “pets and unborn children” on the list, and I think a serious review would probably knock out a third of the names.

The whole idea of selling medallions — any medallions — or allowing drivers to keep them and earn income from them after they retire run directly counter to what Kopp had in mind with Prop. K. And while I couldn’t reach him today, he’s told me in the past that he will put his formidable political capital on the line to block any attempt to change one of his signature pieces of legislation.

And the United Taxicab Workers union doesn’t like the idea of selling medallions, either. Union president Mark Gruberg told me that he sees this as the first step toward allowing all permits to be bought and sold on the market.

“Once you can sell some medallions, the people who hold them will put enormous pressure on the city to expand that program,” he said.

On the other end, Newsom has made no secret of his desire to tap into the potential gold mine that would be opened up if the city simply put the permits up for sale at auction. Sell all 1,500 permits at $200,000 and the city picks up a cool $300 million — enough to make this year’s budget deficit nearly vanish.

So Hayashi’s walking a fine line here, between Kopp and the UTW, which wants no sales at all, and Newsom and his money people, who want to cash out today.

I recognize the problems of the older drivers, but I’m still dubious about the idea that San Francisco somehow owes retirement to people who have insisted their entire careers that they want to be independent contractors, not employed by or managed by anyone. No other small business person who works under those conditions (including, for example, freelance writers, freelance web designers and self-employed accountants) gets to sell a city-owned permit and retire on the proceeds.

And I’m really nervous any time anyone talks about changing Prop. K — because the cab companies would just love to get their hands on those permits, and it will take a mighty effort to keep the drivers in control.

But the ideas floating around now have come a long way from the idea of treating cab medallions like mortgage-backed securities. I’ll keep you posted.
