On the Rise: Avalon Emerson

That delectable boom you hear on dance floors across the city and SoundCloud mixes throughout the cloud-cosmos, overlayed with an earworm diced-diva sample and frenzy-inducing keyboard clang? It’s “Pressure,” the January release from DJ and techno wiz Kahley Avalon Emerson (who goes by her last two names) on local label Icee Hot.

“Pressure’s” a seven-minute beast, and B-side “Quoi” is even deeper, with a smooth acid tune-up mix from the Tuff City Kids. The entire epic shebang has been invading parties like Honey Soundsystem, As You Like It, Icee Hot itself, and Emerson’s own monthly blast, Play It Cool.

And although “Pressure” has been hitting hard in the UK and Australia as well, Emerson is all about transmitting her electronic savvy with a distinctly San Franciscan sensibility. “My next release will drop March 25th on another SF (by way of Paris) label called Spring Theory,” she told us. “It’s called ‘Church of SoMa,’ affectionately named after a big 12-room house in that neighborhood, where I lived and learned to DJ when I first moved here in 2009. It’s more dubby and deep, and it features me singing and playing the Fender Rhodes.”

Emerson came here “to work in tech and get out of Arizona,” but she’s always expressed herself musically. “I’ve been a songwriter since I was a little girl. I was first bit by the studio bug in high school when I bought a few different kinds of microphones, pirated Cool Edit Pro, and recorded my friends’ garage bands. I always liked recording and producing much more than ‘jamming.'”

Heady electronic and house artists like dark-dubby Berliner Shed and Detroit mad scientists Theo Parrish and Carl Craig inspired her to explore more experimental production techniques, and she’s been working with expressionistic, pioneering guitar-software performer Christopher Willits “who has helped me engineer my tracks in his beautiful studio in the East Bay.”

‘Church of SoMa” will help cement Emerson’s emergence on the world techno scene, but she’s got plenty of tunes – and local inspiration — in the vault to keep her momentum going. “For the most part, my music is made to be listened to on a big club sound system — it’s a playful expression of my interests.”

How do you survive here as a musician? What’s the best and worst thing about being a musician in the Bay Area?

SF is not really a place people move to in order to pursue music, and since we’ve been in quite a bit of national news lately, it’s somewhat exotic to be from here. Other than that, it’s so far away from Europe and the East Coast that it’s a little harder to tour. Being a DJ in a 2 o’clock shutdown town with a dwindling selection of alternative music spaces can be a drag, too. But there are venues here like Public Works that have a great sound system and staff, and impressive artists like Matrixxman, Aria Rostam, and Some Ember (who have a killer live show). Also, I love the pho here.

Weirdest thing that’s happened at a show?

Well, last month in Seattle the drugged-out asshat playing after me dropped his Traktor laptop on my record just as I was finishing up my set. I then punished him by playing the entirety of Sinead O’Connor’s “Nothing Compares 2 U,” which is not an easy song or vibe to follow up.

Have you heard the news? Bohemia is dying. All the musicians are leaving San Francisco. Our favorite venues and dingy little clubs are all closing up shop, and being replaced by artisan cocktail bars filled with Google Glasses and reclaimed wood toilet seats.

OK, so some of that is true. The music scene is changing, to be sure; how could it not, with the influx of wealth over the past few years? Yes, we’re sad about Cafe du Nord. Yes, we’re worried about the Elbo Room.

What’s also true: We still have one of the richest musical histories anywhere in the world, and artists aren’t going to stop flocking here anytime soon. One glance at our listings section will tell you there’s live music to be found every single night of the week, and San Francisco’s small size relative to its population — a major factor in the current wave of gentrification and the state of the real estate market — also means that the vast array of genres here, and the communities that exist around different music scenes, all hum along pretty much on top of each other.

In one night, you could take in a jazz jam session in the Haight, a hardcore band in the outer Mission, an Irish folk quartet in North Beach, a synthwave producer in SoMa, a hip-hop show in the Western Addition, and, um, Macaulay Culkin’s pizza-themed Velvet Underground tribute band in the Richmond. (I’ve done all of these recently, and I only regret that last one.) That’s not even touching on the East Bay, which — despite being pronounced almost like an epithet in the city lately, as in “Everyone’s having to move to the East Bay” — is arguably fostering some of the most interesting, nascent micro-scenes in music right now.

With that in mind, we at the Guardian set out to pick 10 artists that we thought deserved our attention in the coming year. We couldn’t narrow it past 11. (Click that first photo up there for a slideshow.) This year’s On the Rise acts come from so many different worlds, have been inspired by so many different artists — Freddie Mercury, MC Lyte, and the 19th century composer Hector Berlioz all make appearances, to give you a taste — and, unsurprisingly, they all make incredibly different kinds of music. Some of these artists are Bay Area natives; some were born on other continents. What they have in common (aside from talent) is a love of this place, its people, its weirdness, and yes, its challenges.

We love them back. And we don’t plan on letting them go anywhere else anytime soon.

Soda tax is social justice issue

We are fighting for a soda tax because public health leaders have sounded the alarm that sugary drinks are a serious threat to our public health. Now is the time to get the word out about the latest facts that tell the story.

Our work on the issue began when community leaders and medical experts started educating us on the impact of sugary drinks. The resulting legislation that we crafted along with four other members of the Board of Supervisors will not only slow soda consumption, but it will fund the anti-hunger and physical activity programs we dearly need.

Most folks know soda is bad for you, but not how bad. Many are also unaware that Big Soda is specifically targeting communities of color and children. Our task is to spread the word about the health disparities this creates.

The lack of healthy food choices is an injustice that is hitting communities of color the hardest. Fully three-fourths of adult Latinos and African Americans in San Francisco are obese or overweight and one in three Americans will soon be diabetic, including one in two Latinos and African Americans.

The disparities are geographic as well. The highest rates of diabetes hospitalizations and emergency room visits are among residents of the Bayview, Tenderloin, SoMa, and Treasure Island. Close behind are the Excelsior and Visitacion Valley. These are also the neighborhoods that lack access to healthy food and are among those consuming the most soda.

We are already paying the high price of soda consumption. San Franciscans spend at the very least $50-60 million a year in health care costs and sick days due to obesity and diabetes attributable to sugary drinks. The fact that sugary drinks are the biggest single source of added sugar in our diets sets it apart from other unhealthy foods.

The revenue generated has tight controls and must be used to mitigate the harm Big Soda causes. Steered by an independent committee and targeted to communities suffering the most from health inequities, the tax will bolster funding for everything from school meals, healthy food retailer incentives, physical education, and other deserving programs.

Big Soda has hired high-priced lobbying firms and public relations folks who are employing a small army of young people, deploying them into the Bayview, the Mission, and Chinatown — those communities most impacted by diabetes and soda consumption. They’ve set up a front group — San Franciscans for an Affordable City — to capitalize on the anger in SF about the cost of housing and living.

But think about it: Have Big Soda companies helped us in our fight for affordable housing? Are they fighting for a living wage for communities of color in San Francisco? They have never cared about an affordable city. They care about protecting their profits, period.

We need affordable housing, healthy foods, and physical activity — issues we are working on every single day. On the other hand, our communities need affordable soda as much as we need cheap cigarettes and booze. It only makes us sick.

There are things our communities are doing to promote good health, like transforming corner stores into healthy retailers, building community gardens, and expanding physical and nutrition education. The soda tax as it is written now can provide these programs and dramatically improve our communities’ health.

This isn’t a ban but a reasonable first step to decrease soda consumption. This is a research-proven way of getting people to use less of an unhealthy product — it worked with cigarettes and it worked with alcohol. Finally, the tax will fund a range of great programs that will actually provide healthy choices for everyone.

It’s time we make the healthy choice the easy choice for low-income communities and all San Franciscans.

SUPER EGO So a toothy blonde pretend social media exec, a blindingly sequined Latina drag queen, a huge rack of elk antlers with hot-pink panties on them, and a pair of Google Glasses walk into a “punk bar” …

What the holy highballs is happening on our bar scene lately? Rowdy Mission hangout Pop’s Bar closed over the weekend. (Who got all those panties, I wonder?) Last week, 40-year-old Mission gay hangout Esta Noche announced it was shutting down (new owners and a hetero-craft cocktail concept). And then there was that oddball Google Glass kerfuffle at Molotov’s, wherein a social media starlet claims she was the victim of a tech hate crime when the patrons allegedly got in her privacy-violating face.

The Esta Noche situation hits close to my floppy liver’s home most, though. With the recent closures of Marlena’s, Deco, and Ginger’s Trois (and the Transfer, Mister Leeona’s, and practically every gay watering hole on Polk Street shuttering in the past decade), there are hardly any queer bars outside the Castro and SoMa left. Lady, can you pour a fierce cosmo out those Google Glasses of yours? Until then, I won’t have what she’s having. I need my queer space to get sozzled!

 

JAY TRIPWIRE

There are DJs to love, and then there are DJs to love. Fiercely intelligent yet laidback, shaggy in that classic rave-dude way, Vancouverite Jay Tripwire has been honing his deep, deep techno sound for more than two decades and 200 releases. Like every great DJ wizard, he transforms the records on his tables into other beasts entirely. You just hear differently after his masterly sets. At the Housepitality weekly, he’ll get a warm reception.

Crooked cops

It’s a bombshell police scandal befitting San Francisco’s restive mood, dropping at a time when simmering class tensions have been making national news, and one more example of how the poor are getting trammeled by those with power.

As politicians and tech titans were trying to make the gritty central city more welcoming to corporations and their workers three years ago, a half-dozen plain-clothed police officers were allegedly abusing poor people, illegally busting into their rooms, stealing anything that had value, forcing criminals to sell stolen drugs for them, and repeatedly telling lies in police reports.

When the targets of these abuses complained to the authorities, they were dismissed or ignored. Only when Public Defender Jeff Adachi and his investigators found and publicly revealed damning video surveillance from the targeted single-room occupancy hotels did federal authorities launch an investigation.

Adachi held press conferences in March and May of 2011 showing officers brutalizing SRO residents and leaving their rooms with laptops and other valuables that were never booked as evidence. When Greg Suhr was sworn in as police chief in April 2011, he put the officers on administrative duties, forced some to give up their weapons, changed department policies to deter cops from barging into people’s rooms without warrants or probable cause, and cooperated with the Federal Bureau of Investigation on the case.

That investigation resulted in federal grand jury indictments that were unsealed on Feb. 27, charging six SFPD cops with a variety of serious charges, including civil rights violations and conspiracies, theft, extortion, drug conspiracies, and falsification of records.

They are Officers Arshad Razzak, Richard Yick, and Raul Eric Elias, who worked in Southern Station, dealing with residents of SoMa SROs; and Sgt. Ian Furminger, Officer Edmond Robles, and Reynaldo Vargas (who Suhr says was dismissed from SFPD for unrelated reasons as the investigation got underway), who worked in Mission Station, where the drug conspiracy allegedly took place, on top of shakedowns in Mission District SROs.

All defendants are facing more than 20 years in prison (except Elias, who faces 10 years for civil rights conspiracy and one year for deprivation of rights under color of law). The Southern Station defendants are also facing $250,000 in fines. The Mission Station defendants face $1 million in fines on the drug conspiracy charges, which allegedly involved having informants sell a few pounds worth of marijuana seized by police.

Attorney Michael Rains, who represents Razzak and has been designated by the San Francisco Police Officers Association as a spokesperson for the others, told the Guardian that all the defendants had difficult undercover jobs in the murky world of informants and drug dealers.

“There was sloppiness in the reporting [in officials police reports], but sloppiness doesn’t rise to the level of criminal activity,” Rains told us, questioning the credibility of witnesses who have criminal records and the reliability and context of the video evidence.

But Suhr strongly condemned the behavior outlined in the criminal complaints, telling reporters that other SFPD officers connected to the case may still face disciplinary action and that, “My officers know I will not have dishonest cops among us.”

He called the indictments a serious blow to the SFPD, appearing to choke up with emotion.

“Our department is shaken,” Suhr, who has been with the SFPD more than 30 years, told reporters. “This is as serious a matter as I’ve ever encountered in the Police Department.”

Yet Suhr also distanced himself from scandal, telling reporters, “This conduct occurred before my time as chief.”

Most of the alleged crimes happened under former Police Chief and current District Attorney George Gascón shortly before he made that transition, one in which critics at the time raised concerns about whether he could be an effective watchdog of SFPD misconduct. That conflict of interest was what sent this case to the feds.

“It is extremely disappointing that the officers violated the trust of the community and tarnished the reputation of all the hard working men and women in uniform,” Gascón said in a press release.

During a brief press conference that afternoon, Gascón denied responsibility for the misconduct: “Anytime you have a large organization, you are going to have people who operate outside the boundaries of what is acceptable.”

Asked by the Guardian when he became aware of allegations that his officers were abusing SRO residents, he said, “We became aware at the same time everyone else did, when the videos came out.”

Gascón’s Press Secretary Alex Bastian cut the press availability off after 10 minutes so Gascón could prepare for his State of Public Safety speech that afternoon, but Bastian told the Guardian he would get answers to our questions about the office’s police accountability record.

“When appropriate, we ensure the integrity of the system is not compromised by referring cases to other prosecuting agencies. In the abundance of caution, when this case was brought to my attention, I referred the case to the federal authorities to safeguard a thorough investigation and guarantee maximum consequences,” Gascón said in a prepared response, while Bastian ignored our requests for more responsive answers to our questions.

But Adachi says these indictments are just the tip of the police misconduct iceberg, charging that police officers routinely lie in police reports and in court to justify illegal searches and other abuses of defendants who are poor or have drug problems, knowing that judges and juries tend to believe cops over criminals.

“The indictments today are a victory for ordinary San Franciscans,” Adachi told reporters, emphasizing that in addition to personally profiting from the shakedowns, these officers were also submitting false testimony in perhaps hundreds of cases, including about 100 that his office has gotten dismissed. “These allegations not only involve violations of the constitutional rights of our clients, but also lying on police records that were used to send individuals to prison based on the testimony of these officers.”

Residents and employees of the Henry Hotel, one of four SROs involved in this case, told the Guardian that the indictments are a rare repudiation of police mistreatment of SRO residents, which they say continues to the day.

“A lot of these people need help. They need guidance. They need a program. They need somebody to motivate them to go to their programs, not a fucking cop who keeps harassing them,” Jessie Demmings, a manager at the 132-room Henry Hotel on Sixth Street, told the Guardian. “They try to take that one step to go forward and then when you come outside you get greeted by a fucking cop having a bad day.”

Even though new SFPD policies prohibit officers from using passkeys to enter people’s rooms without a warrant, Demmings said it still happens. “The reason why we give the passkey is because they always threaten we’re gonna kick in the door, we gonna have a batting ram come and bust the door in,” he said.

Adachi cited his office’s long history of cases in which “officers were barging into rooms without warrants and they were lying about it in police reports.”

Cases of police abuse are handled by the city’s Office of Citizen Complaints, but its work is shrouded in secrecy, thanks to the California Peace Officers Bill of Rights, and officers rarely face serious consequences for their actions.

“We do have complaints with regard to the conduct within the SROs and we have made policy recommendations to the chief,” OCC Director Joyce Hicks told reporters at the SFPD press conference. She called the indictments “extra serious because it implicates the Fourth Amendment and people’s rights.”

Adachi said that after revealing the videos in 2011, he persuaded Mayor Ed Lee to fund two positions in his office investigating police misconduct, but the Mayor’s Office defunded those positions after a year and ignored Adachi’s calls to restore them (as well as Bay Guardian calls for comment on the issue).

“We felt like the public needs to know about this,” Adachi said of the behavior revealed by the federal investigation. “What happened today is significant, and I think it will have deterrent effect.”

Nite Trax: Esta Noche to close, adios Esta Noche

Not even a guest starring role on Looking could save beloved Latino-oriented gay dive Esta Noche, alas! According to Eater SF, the Mission favorite is being sold by its owners reportedly willingly — to the team behind SoMa meat market Wish.

The new owners take over next week, but will keep things the same for a while, in order for everyone to have some time to say goodbye. (New Mission businesses, please take note: this is how you help avoid a PR nightmare.) Then get ready for more craft cocktails and loungey vibes, Missionites! Ugh.

I like the Wish kids, and I know that the Esta Noche tale is more complex than a simple eviction. Still, it’s heartbreaking to see a community mainstay — 40 years! — shutter, especially one that caters to a different crowd than Castro-roaming bachelorettes and tired Britney queens. Legendary comedy nights, hilarious performances, and, of course, the insane Miss Gay Primavera contest all played out on its stage. And where the hell can I hear Norteno music while cruising cute boys now?

With this coming hard on the heels of the 77 Geary building booting out its art galleries for tech companies, it has been suggested that the Guardian should start a column shaped like a tombstone, listing all the things we’re losing. But at least we’ll have craft cocktails! 

Staying power

Despite the rain on Feb. 8, organizers of a citywide tenants’ convention at San Francisco’s Tenderloin Elementary School wound up having to turn people away at the door. The meeting was filled to capacity, even though it had been moved at the last minute to accommodate a larger crowd than initially anticipated.

“Oh. My. God. Look at how many of you there are!” organizer Sara Shortt, executive director of the Housing Rights Committee, called out as she greeted the hundreds in attendance. “Tenants in San Francisco, presente!”

The multiracial crowd was representative of neighborhoods from across the city, from elderly folks with canes to parents with small children in tow. Translators had been brought in to accommodate Chinese and Spanish-speaking participants.

Six members of the San Francisco Board of Supervisors also made an appearance: Sups. John Avalos, David Campos, Eric Mar, Malia Cohen, Jane Kim, and Board President David Chiu.

In recent weeks, the convention organizers had convened a series of smaller neighborhood gatherings to solicit ideas for new policy measures to stem the tide of evictions and displacement, a problem that has steadily risen to the level of the defining issue of our times in San Francisco.

While several legislative proposals are on track to move forward at the Board of Supervisors, the meetings were called to directly involve impacted communities and give them an opportunity to shape the legislative agenda on their own terms, according to various organizers.

Addressing the crowd, Shortt recalled what she termed “some amazing jiu jitsu” during last year’s tenant campaigns, which resulted in a 10-year moratorium on condo conversions rather than simply allowing a mass bypass of the condo lottery, as originally proposed.

That measure, which won approval at the Board of Supervisors last June, was designed to discourage real estate speculators from evicting tenants to convert buildings to tenancies-in-common, a shared housing arrangement that’s often a precursor to converting rent-controlled apartments into condos.

That effort brought together the founding members of the Anti Displacement Coalition, and momentum has been building ever since. “This is the beginning of a movement today,” Gen Fujioka of the Chinatown Community Development Center, one of the key organizations involved, told the gathering. “We are shaking things up in our city.”

 

MAINTAINING DIVERSITY

Around 160 participants attended the first in a series of neighborhood tenant conventions in the Castro on Jan. 10. The one in the Richmond a week later drew so many participants that organizers had to turn people away to appease the fire marshal.

“The idea of the neighborhood conventions was to solicit ideas,” explained Ted Gullicksen, head of the San Francisco Tenants Union. “The idea of this event is to review existing ideas and ultimately rank them.” From there, the campaign will pursue a ballot initiative or legislative approval at the Board of Supervisors.

But first, a few speakers shared their stories. Gum Gee Lee spoke about being evicted from her Chinatown apartment last year along with her husband and disabled adult daughter, an event that touched off a media frenzy about the affordable housing crisis taking root in San Francisco.

“There were times that were very stressful for me. I would call places only for the owner to say, ‘I’ll get back to you,’ but they never did,” she said of that ordeal.

“To see everyone here, all kinds of people, it makes me really happy,” she later told the Bay Guardian through a translator. “I just hope they don’t get evicted.”

Mike Casey, president of UNITE-HERE Local 2 and an executive committee member of the San Francisco Labor Council, also made a few comments at the forum.

“Having the ability to live and vote in this city makes a difference,” he pointed out, saying workers who have to commute long distances for political actions because they’ve been displaced from San Francisco are less likely to get involved.

“The struggle of our time is the widening gap between the rich and the poor,” Casey added. “That is exactly what this struggle is about: to maintain that diversity. What we need to move forward on is bold, effective, measurable change that makes sure we are able to protect the fabric of this community.”

Maria Zamudio, an organizer with Causa Justa/Just Cause, emphasized the idea that the problem of evictions in San Francisco is less of a market-based problem and more of a threat to the city’s existing, interwoven communities.

“Those are our neighborhoods and our communities,” Zamudio said. “We’re fighting for the heart of San Francisco. Fighting for strong tenant protections is a necessary struggle if we are going to keep working class San Franciscans in their homes.”

 

ELLIS ACT UNDER FIRE

As Gullicksen noted at the start of the convention, San Francisco rents have ballooned in recent years, rising 72 percent since 2011.

“We are seeing the most evictions we have seen in a long, long, long, long time,” Gullicksen said. “Most Ellis evictions are being done by one of 12 real estate speculators — evicting us and selling our apartments, mostly to the tech workers.”

Even though median market-rate rents now hover at around $3,400 per month in San Francisco, low-income tenants can avoid being frozen out by sudden rental spikes because rent-control laws limit the amount rents may be increased annually.

But that protection only applies to a finite number of rental units, those built before 1979. That’s why tenant advocates speak of the city’s “rent-controlled housing stock” as a precious resource in decline. Long-term tenants with rent control — in the worst cases, elderly or disabled residents who might be homeless if not for the low rent — are often the ones on the receiving end of eviction notices.

From 2012 to 2013, according to data compiled by the Anti Eviction Mapping Project, the use of the Ellis Act increased 175 percent in comparison with the previous year. That law allows landlords to evict tenants even if they’ve never violated lease terms. Advocates say real estate speculators frequently abuse Ellis by buying up properties and immediately clearing all tenants.

Concurrently with local efforts agitating for new renter protections, organizers from throughout California are pushing to reform the Ellis Act in Sacramento.

Assemblymember Tom Ammiano has promised to introduce a proposal by the Feb. 21 deadline for submitting new legislation, and Sen. Mark Leno is working in tandem with San Francisco Mayor Ed Lee on a parallel track to pursue some legislative tweaks aimed at softening the blow from the Ellis Act.

“Our goal is to change the conversation in Sacramento, where tenants’ concerns are routinely ignored,” said Dean Preston, director of Tenants Together, a statewide organization based in San Francisco.

On Feb. 18, busloads of protesters will caravan to Sacramento from San Francisco, Oakland, and Fresno for a rally. Preston said they’ve got three demands: reform the Ellis Act, restore a $191 million fund that provides financial assistance for low-income and senior renters, and pass Senate Bill 391, which would provide new funding for the construction of affordable housing.

Even though the law is technically intended to allow property owners to “go out of the business” of being a landlord, Ellis Act evictions in San Francisco are most often carried out by speculators who purchase real estate already occupied by tenants, Gullicksen said.

“Our focus is on the most immediate problem, which is the misuse of the Ellis Act by real estate speculators,” Preston said. “It’s urgent to address that specific use. That’s what Ammiano and Leno are looking at, is ‘what’s the best way to stop speculative use?'”

 

LOCAL POLICY CHANGES SOUGHT

Tyler McMillan of the Eviction Defense Collaborative said his group is often the last resort for tenants threatened with the loss of their rental units. “Too often, we face a losing fight at court,” he said. “We need to write better laws that work better to keep people in their homes.”

The legislative proposals moving forward at the local level seek to attack the problem of evictions and displacement from several angles. On Feb. 3, Sup. David Campos introduced legislation to require landlords who invoke the Ellis Act to pay a higher relocation fee to displaced tenants, equaling two years’ worth of the difference between the tenants’ rent and what would have been considered market rate for that same unit.

“It is time that we recognize that tenants must receive assistance that is commensurate with market increases in rent if we are to truly address our affordability crisis and check the rampant growth of Ellis Act evictions,” Campos said.

As things stand, relocation assistance payments are around $5,261 per tenant, and are capped at $15,783 per unit, with higher payments required for elderly or disabled tenants. But at current market rates, a tenant would not last more than a few months in the city relying solely on the relocation fee to cover rental payments.

Surveying the strong turnout at the tenant convention, Campos said, “There is a movement that’s happening in San Francisco to take our city back, and to make it affordable for all of us.” Yet he noted that he is concerned there will be major pushback from the San Francisco Apartment Association and the real estate industry, formidable interests that oppose the relocation fee increase.

Meanwhile, Sup. Mar has proposed an ordinance that would require the city to track the conversion of rental units to tenancies-in-common, a housing arrangement where multiple parties own shares of a building through a common mortgage. Speculators who buy up properties and immediately evict under the Ellis Act often angle for windfall profits by immediately converting those units to TICs.

Campos is also working on legislation that would regulate landlords’ practice of offering tenants a buyout in lieu of an eviction, a trend advocates say has resulted in far greater displacement than Ellis Act evictions without the same kind of public transparency.

Peter Cohen of the Council on Community Housing Organizations said there’s “no silver bullet” to remedy San Francisco’s affordable housing crisis. “This process is going to come up with another bundle of things,” he said. “All of that is also complimentary to the state campaign. You could have five, six, or seven policy measures going forward — and all of them winnable.”

An idea Cohen said has received traction is the idea of imposing an anti-speculation tax to discourage real estate brokers who abuse the Ellis Act by buying up properties and evicting all tenants soon thereafter (see “Seeking solutions,” for details).

During a breakout session at the tenant convention, longtime LGBT activist Cleve Jones piped up to say, “Harvey Milk proposed the anti-speculation tax back in 1979.”

It wasn’t successful at that time, but Cohen said that given the current level of concern about housing in San Francisco, it’s being talked about in some circles as the most winnable ballot initiative idea.

 

TENANTS FIGHTING BACK

At the Feb. 8 convention, tenants shared stories of challenging orders to vacate their rental properties. “The most important thing that has brought us to the victories we’ve had so far is that tenants have stayed in their homes,” Shortt said. “Tenants have fought, tenants have sought help, tenants have organized.”

Tenants from a North Beach building owned by real estate broker Urban Green shared their story of banding together and successfully challenging an Ellis Act eviction. Chandra Redack, a nine-year resident of 1049 Market St., where tenants continue battling with owners who submitted eviction notices last fall, described to the Bay Guardian how her small group of tenants has continued to organize in the face of ongoing pressure, including the owners’ recent refusal to accept rent checks.

“Our organizations only can support tenants when they stand up and fight,” said Fujioka. “The tenants’ resistance themselves is part of the strategy. If we don’t have rights, we are going to create them.”

Paula Tejeda, a longtime resident of the Mission District originally from Chile, told the Bay Guardian that she’d been threatened with an eviction from her home of 17 years, a Victorian flat on San Carlos Street.

“I thought I was dealing with an Ellis Act, now he’s trying his best for a buyout,” she explained.

Living in that rent-controlled unit made it financially feasible for her to contribute to the Mission community as a small business owner, as well as a poet, author, and active member of the arts community, she said. Tejeda is the proprietor of Chile Lindo, an empanada shop at 16th and Van Ness streets.

“Having the rent control made it possible for me to build Chile Lindo, go back to college and get my MBA,” she said. That in turn gave her the resources to employ one full-time and three part-time staff members, she said.

When she was initially faced with the prospect of moving out, “I wanted to shut down and leave, and go back to Chile,” she said. “We are suffocated, as a society that cares only about the bottom line.”

But surveying the hordes of tenants milling about at the convention, she seemed a bit more optimistic. “The fact that this is happening to everyone at the same time,” she reflected, “is kind of like a mixed blessing.”

Seeking solutions

A number of policy ideas emerged from the neighborhood tenant conventions, which were held by the San Francisco Anti Displacement Coalition in the Mission, Chinatown, Haight/Richmond, Castro, SoMa, and the Tenderloin.

Here’s a list of what tenants came up with at those forums, which attendees ranked in ballots collected at the event. The ideas will most likely result in a November ballot initiative and one or more legislative proposals, which organizers plan to announce in the near future.

Anti-speculation tax: One idea is to impose a tax on windfall profits garnered by speculators who buy up housing and then sell it off without maintaining ownership for at least six years. The tax would be structured in such a way that the quicker the “flip,” the higher the tax. This would require voter approval.

Eviction moratorium: This proposal is to put a yearlong freeze on certain kinds of “no-fault evictions,” instances where a tenant is ousted regardless of compliance with lease terms. State law would prohibit it from applying to Ellis Act evictions. It might potentially require voter approval.

Department of Rent Control Enforcement and Compliance: This new department, which could be done by local legislation, would create a new city department with the mission and mandate to enforce existing tenant-protection laws and conduct research on eviction trends.

Relocation assistance: While Sup. David Campos is working on legislation to upgrade relocation assistance payments to displaced tenants who face eviction under the Ellis Act, this proposal would do the same for all other forms of “no-fault” evictions. This would require voter approval.

“Excessive rents” tax: While the Costa-Hawkins state law does not allow for cities to control rents in vacant units, this proposal would create a tax on new rental agreements where rents exceed an affordability threshold.

Housing balance requirement: This proposal would make it so that approval of new market-rate housing would be restricted based on whether affordable housing goals were being met. It would create new incentives to build affordable.

Legalize illegal units: This would provide a way to legalize the city’s “illegal” housing units that nevertheless provide a safe and decent source of affordable housing. (Board President David Chiu has already introduced a version of this proposal.)

Dutch show how SF cycling could grow

OPINION During rush hour, seeing the intersection at Weesperzijde and Meester Treublaan in Amsterdam would make a San Franciscan gasp. As cars move forward, cyclists continually pedal past, undisturbed by traffic—20, 30, or 40 at a time, in both directions—onto the narrow Weesperzijde, which runs along the Amstel River.

For the Dutch, this is the norm. In the Netherlands, the average person takes 300 bike rides per year covering roughly 560 miles. Cycling deaths remain the lowest in the world.

If only this were true elsewhere. In San Francisco, four people were hit and killed while biking in and around SoMa in 2013. As of Nov. 14, the fifth person in nine days was killed cycling on London’s roads. On both sides of the Atlantic, the issue raised by such tragedies remains the same: as long as roads favor cars, cyclists are at a dangerous disadvantage.

As a former San Franciscan now living in Amsterdam, I am continually impressed by the comprehensive infrastructure that allows me to bike everywhere safely. But it didn’t come out of nowhere.

The Dutch had their love affair with cars, too. In rebuilding itself after World War II, the country became prosperous, and with more money flooding in, people ditched their bikes for cars. Because Dutch cities are small, densely populated, and hemmed in by canals, there wasn’t a great deal of room to expand. As cars piled onto the streets, traffic-related deaths soared. In 1971 alone, cars killed more than 3,000 people, 450 of which were children. The public, outraged that this was too high a price to pay, started demonstrating.

In 1973, the international oil crisis hit, heightening concerns about oil dependency. This also pushed the Dutch to invest in the cycling infrastructure we see today—where every major street contains separate bike lanes and traffic lights.

Cycling here looks very different from San Francisco: couples hold hands, mothers willingly cart their children from A to B and people hold conversations as they ride along bike paths separated from the road. Legally, too, Dutch cyclists have the right of way on the road. According to the ANWB, the Dutch tourism and car owners’ association, car drivers are liable for accidents unless they can prove they were overpowered by circumstances beyond their control.

Having lived in Amsterdam several years now, I am convinced that recreating the Dutch system elsewhere will take more than better bike lanes. In the Netherlands, cycling regularly (and not just for sport) has been ingrained for generations. Dutch children learn the importance, relevance, and necessity of cycling at an early age, and they learn how to do it well and therefore, safely.

In Dutch schools, cycling proficiency lessons are compulsory. Children have to pass two tests—one, an exam on road rules; the second, cycling through traffic— to earn a bike diploma. When these children cycle along bike paths, they are cycling next to drivers who have also cycled most of their lives, and are looking out for them.

In the USA, getting drivers to think about cyclists sharing the roads is going to be a gradual process. When cycling in San Francisco a decade ago, I was once sideswiped by a driver too busy looking left at oncoming traffic to notice I was on his right side. As he turned right and knocked me over, thank god at only 5 mph, I was so shocked I apologized. But he was at fault. A friend of my mother’s once joked I should be careful “because people like me never look out for cyclists.” Cycling deaths constantly prove this is really no joke.

While it is more challenging to build cycling infrastructure in America as there are greater distances to cover, with no infrastructure, nothing happens. Build it, and yes, the cyclists will come—but then you have to remind everyone else that cyclists are there. Do it repeatedly and years from now, we can boast it really works, just as it does in Holland.

Development must protect the arts

OPINION Recently, the Bay Guardian ran an article critical of The Marsh theater’s position on the condo development proposed for 1050 Valencia St. (see “Street Fight: Driving us crazy,” 11/12). It incorrectly claimed that we oppose the project. Thank you, Guardian, for now giving us the opportunity to set the record straight.

The Marsh does not oppose a proposal to develop condominiums and commercial space next door to us at 1050 Valencia St. Rather, we are trying to get conditions attached to the project’s building permit — for both during and after construction — that reflect that this developer chose to build up against a world-renowned, community-based theater. We believe it is reasonable to expect the developer to be a good neighbor.

For almost 25 years, The Marsh has developed solo performances, presenting nearly 700 performances annually with 400 in our Mission location alone. We also offer solo performance workshops and year-round after-school classes and camps for youth where no child — toddler through teen — is turned away because of lack of money. We foster risk-taking and diverse artists from novices to those with worldwide acclaim, giving voice to the vital stories of our times.

The construction plans for 1050 Valencia directly affect our theater space and our ability to continue to host live performance. As currently designed, the plans for both construction and occupancy could mean noise that would drown out unamplified solo performance. The project will also reduce theater lighting and ventilation.

We’ve seen the history of new affluent residents in fancy SoMa live/work lofts who didn’t like living next to the loud music and milling crowds they chose to move near. These wealthy newcomers could afford to hire lawyers and fight expensive legal battles, and they successfully closed down entertainment venues that had defined SoMa for decades. We seek conditions to prevent this from happening to us.

We are requesting the large open deck adjacent to our building be moved behind a sound barrier. We are concerned that when residents have a party or open their windows with music blaring, the sound will disrupt our performances. This endangers our existence. We are also asking for conditions prohibiting the commercial space next to us from having live entertainment that would impact our performances.

Without specific legally enforceable conditions attached to the permits, we have no recourse if the developer or subsequent property owners lack good faith. To date, based on developer Mark Rutherford’s treatment of us, we have no reason to believe in his good faith. San Francisco’s development history shows that only legally enforceable conditions really protect the public interest over the “lifetime” of a building’s construction and use.

The Marsh is a metaphor for the current displacement of people and culture in the Mission District. Miraculously, we were able to purchase our building in 1996, a market low, with the support of our artists, patrons, board, and forward-looking foundation and nonprofit and commercial loan entities. Otherwise, The Marsh would not exist today. We would never have been able to afford today’s market-rate rent.

We are now a safe house for artists to develop their work at our space, for the children who take our affordable classes, and the audiences who attend our critically-acclaimed shows. But we are not indestructible. If protective conditions are not written into the building permit, and we end up with disrupted programs and performances, we will not survive artistically or financially.

Will The Marsh go the way of our neighbors? Will we be developed into a bunch of two-bedroom condos selling for $1.75-2.25 million, like the ones at 19th and Valencia? With maybe two below-market rate units set aside, as planned for 1050 Valencia, where “below market” could mean $1 million. But where will the artists go? Where will young aspiring performers go? The audiences?
