A look back: The “Candlestick Swindle” in ’68

San Francisco spent this week saying goodbye to its beloved foggy stadium, Candlestick Park. Amidst the farewells, the Guardian spotted a post from sports blog Deadspin, which reprinted one of our articles from 1968  titled, “Before We Build Another Stadium… The Candlestick Swindle.” 

When we saw the post, we started thumbing through our archives looking for the article. Though Deadspin said it was from 1972, we found it in Vol. 2, Issue no. 10, May 14, 1968, it’s a down and dirty tale of intimidation, bypassing voters through dummy corporations, profiteering, and racism. Candlestick has a colorful history, to say the least. 

The author, Burton H. Wolfe (Burton, not “Mr. Wolfe,” he wrote via email), gave us permission to re-publish it in full here. Just for fun, we’re also embedding the original issue as a PDF, which can be download and printed. Looking through the issue, it’s heartening (and disheartening) how much, and how little, changes.

 

The Candlestick Swindle

It all began early in 1953. Mayor Elmer Robinson’s administration—and local businessmen—decided to import big league baseball for San Francisco’s economic and recreational benefit. A downtown stadium was adequate for San Francisco’s AAA minor league club, the Seals, but not for major league fare.

Hence, Robinson asked the Board of Supervisors to approve a $5 million bond proposition to construct a new stadium. Among the supervisors in approval: George Christopher, soon to become mayor; Gene McAteer, headed for the state senate; Francis McCarty, a future judge; Harold Dobbs, restaurateur and budding Republican candidate for mayor, and John Jay Ferdon, future district attorney.

In July of that same year, 1953, a local multi-millionaire contractor named Charles Harney purchased 65 acres of land at Candlestick Point from the city of San Francisco for $2,100 an acre.

Next year, a band of publicists headed by Curley Grieve, S.F. Examiner sports editor, beat the drums and called the natives to pass this bond issue proposition:

To incur a bonded indebtedness in the sum of $5 million for the acquisition, construction and completion of buildings, lands and other works and properties to be used for baseball, football, other sports, dramatic productions and other lawful uses as a recreation center.

Major league baseball, they proclaimed, would bring untold wealth to the city for a mere $5 million, a price that would be returned many times. After voters approved this in November, 1954, the search began for a site. If there were any doubts the stadium would cost more than $5 million, they were dispelled in a personal meeting between Robinson’s successor, Mayor Christopher, and the owner of the New York Giants, Horace Stoneham.

In April, 1957, Christopher and McCarty flew to New York to talk Stoneham into bringing the Giants to San Francisco. The Giants were losing money in New York, and scouting the country for a new home base.

To prove San Francisco’s support for professional baseball, Christopher waved the $5 million stadium bond issue at Stoneham. According to testimony reported by the 1968 grand jury investigation, Stoneham replied contemptuously:

Any figure other than 10 or 11 million dollars shouldn’t even be discussed because there would be no possibility or probability of a major club moving to that particular community.

Back in San Francisco, Christopher reported the need for more money to other city leaders and businessmen. Since the proposition suddenly to double the original bond issue might run into trouble with the voters, they decided to create a non-profit corporation called Stadium, Inc., as a legal arm of the city.

Bypassing the Voters

Operating through this dummy corporation, the Christopher administration could bypass the voters to raise more money.

Harney and two of his employees were selected as the first board of directors of Stadium, Inc. Christopher told Harney that he would be the contractor to build the new stadium, and his 41 acres of Candlestick land would be the heart of the 77-acre location.

In 1957, Harney sold back 41 acres of the parcel he had purchased from the city in 1953 at $2,100 an acre. The 1957 price the city paid to Harney for its own former land was $65,853 an acre. That’s a crisp total of $2.7 million.

The city’s Real Estate Department approved the deal even though other land adjacent to Harney’s was bought at about the same time for just $6,540 an acre. Harney made a profit of $2.6 million on the four-year land ownership switch.

Not so, Christopher and Harney later contended. Harney had graded and filled the land, and so naturally he was paid for his improvements. One fact raised doubts about that explanation: a $7 million fee awarded to Harney to construct the new stadium included $2 million for stadium construction, $2 million for grading and filling and $2.7 million for real estate.

Had it not been for the creation of Stadium, Inc., the Christopher administration would have been required to hold open, competitive bidding for the contract, and voters would have seen the price tags.

By operating through Stadium, Inc., Christopher was able to evade the city charter and arrange the contract in a privately negotiated deal.

Through the same apparatus, his administration was able to float another $5.5 million bond issue without voter approval. The interest rate on these bonds was set at 5% whereas the interest on the original $5 million bond issue was only 2.4%, a difference that would eventually cost the city hundreds of thousands of dollars.

Evading an Investigation

In February, 1958, Harney and his employees were removed from the board of Stadium, Inc., after, as the grand jury report later pointed out, “Three influential men then were substituted to represent the city’s interest—Alan K. Brown, W.P. Fuller Brawne and Frederic P. Whitman.”

The maneuver came too late to prevent Henry E. North from instigating a Grand Jury investigation into the strange transactions.

North, like Christopher, was a Republican and a conservative member of the San Francisco business community. Until his retirement, at 70, he had been executive vice-president of one of the largest property owners in the city: the Metropolitan Life Insurance Company. He had a strong sense of civic duty, however, and the Candlestick Park deal smelled to him of garbage.

The report North issued, as the result of the Grand Jury investigation, was potential dynamite. It showed that, shortly before the city purchased Harney’s land at $65,853 an acre, adjacent pieces of tideland were sold by the city for less that $4,000 an acre. It did not make sense that Harney’s land, partly under water, should have brought $61,000 more from city coffers.

On Dec. 2, 1958, the San Francisco Chronicle carried partial coverage of the Grand Jury report. On page 5, the year Harney purchased the city land was stated as 1933 rather than 1953. Of course, the 20-year difference would provide a reason for the tremendous increase in value, because the initial purchase price would have been at depression levels.

Undoubtedly, it was a typographical error. And no doubt it was by unintentional omission that other salient features of the Grand Jury report were omitted altogether and never printed by the Chronicle or any other major newspaper.

North charged that all bond issues negotiated by Stadium, Inc. were illegal evasions of the city charter. Bond payments had to be made from city funds, not the dummy nonprofit corporation, and so the whole deal amounted to legal subterfuge; a way to make taxpayers foot the bill without letting them vote on it.

The report, drafted by North and signed by 18 other citizens, estimated annual payments on the bonds of $990,000 for the first 15 years of the debt period. Against that, the city was to draw $225,000 a year in rent from the Giants and $225,000 a year from advertising and parking revenues, leaving a balance of $640,000 to be paid annually from taxes or city funds. It was estimated that the city could make up the balance by commanding the juicy television rights; instead, Christopher arranged for rights to go exclusively to the Giants.

Altogether, it was a marvelous deal for the Giants. In their last New York season, attendance at the Polo Grounds plummeted to 684,000. The club had gone broke and it was almost impossible to give away its stock. After the Giants first season in San Francisco in 1958, attendance tripled over its last year in New York, and their stock soared to $1,000 a share. In terms of revenue, the increase in gate receipts alone meant $3 million the first year.

While the Giants were reaping enormous profits at taxpayers expense, City Hall and the local newspapers were trying to make it appear that San Francisco, too, was earning money. The News-Call Bulletin, the now defunct Hearst paper, once stated that when all returns are in, the season just ended (1960) will have yielded the city about $530,000. The fact was that the sole revenue to the city was $50,000 received to maintain buildings and grounds.

The other Hearst paper, the Examiner, stated, on the other hand: City Hall officials said $375,000 of the revenue figure will be used to pay the annual cost of the city’s $5 million bond issue. The Chronicle published this figure: Of the remaining $527,000, the first $375,000 must go toward payment of the city’s $5 million stadium bond issue.

The fact was that all revenues from the ball park and its parking lot had to be used to pay off the $5.5 million worth of bonds issued by Stadium, Inc., with the exception of the $50,000 maintenance income. The other $5 million worth, issued by the city, had to be paid off through real and personal or property taxes collected by the city.

The result: a projected loss, not profit, of $640,000 the city must pay from taxes or other general city revenues (according to the Grand Jury report), and a loss this year of at least $360,000 (according to figures supplied to The Guardian by the city controller’s office and Mike Barrett, the Bank of America executive who handles Stadium, Inc.’s trustee account.)

Some annual loss on Candlestick Park will continue until 1993, when the stadium will finally be free of debt and owned completely by the city—unless, it is torn down before then or reconstructed, which will add more debt.

There was another interesting development at Candlestick: Stevens California Enterprises, which got the food and beverage concession at the ball park, bought all its milk until two seasons ago from Christopher’s milk company, Christopher Dairy Farms. The Borden Co. now has the lucrative contract.

Even though City Hall and the newspapers were misstating facts about the Candlestick story, San Francisco restaurateurs, hotel owners and shopkeepers at least began to realize that they were not making any money from the ball park, as promised by the ballyhooers. Only the Giants, Harney, and Christopher were making money. The Giants were attracting few additional tourists to San Francisco, and area fans who journeyed to isolated Candlestick Point, several miles away, did not stop to patronize downtown establishments. Some downtown business men were angry, and if North’s crusade were given time and publicity, they might cause an uncomfortable controversy.

Christopher sent emissaries to North, but he would not be wooed or pressured from his stand. To the contrary, he made even more vigorous attacks on Christopher and the ball park deal. The lives of future generations had been mortgaged by this shoddy piece of business, he maintained. Christopher was diverting city funds from various departments: $1.4 million from street improvement bonds, $1.2 million from state gasoline taxes given to the city for road improvements, $1.5 million from sewer bonds for services to the Giants ball park.

A Hidden Payoff?

Already the cost was $15 million, and it might exceed $20 million when various exits, entrances, widened access streets and the like were built to handle the anticipated large crowds. Privately, North informed civic and business leaders that there was an underhanded payoff in the deal, and he intended to expose it.

Christopher reacted viscerally to North’s charges. With newspapermen present, he asserted North was drunk, incoherent, and fixable. The description was published in the newspapers.

North went to Nate Cohn, one of the foremost criminal lawyers in California, and they filed a $2 million libel suit against Christopher. In a pre-trial hearing, Christopher’s attorney filed a thick brief with 45 motions for dismissal of the suit, hoping to tie up the case inextricably. In just an hour and a half, Superior Court judge Preston Devine threw out all 45 motions, indicating clearly that Cohn and North had a good case.

Breaking Down North

Christopher’s friends in the business community went to work on North. The publisher of one of the three daily newspapers, North told me, called on him and said, “Henry, why don’t you play ball? You’re giving the city a bad name, stirring things up like this.”

At the Pacific Union Club across the street from the Fairmont Hotel on Nob Hill, where North was already in disfavor for bringing Jewish guests despite the no-Jews-allowed policy, fellow Republican business executives started a snub-North routine. One day, for example, an old business friend greeted North:

“Say, Henry, I see in the papers there’s some fellow named Henry North filing a suit against the mayor and stirring things up. Must be another Henry North in this town, huh?”

“No, that’s me,” North told him.

“Is that so?” the old friend said. He turned his back on North and never spoke to him again.

I talked to North several times during the siege because I was publishing articles about Candlestick Park in my magazine, The Californian (now defunct). In those days he was full of fight, willing to take on City Hall and the entire business establishment even if it meant losing every friend he had. He promised to tell me the names of the men involved in the payoff, and he excoriated Christopher.

“You know what I call men like George Christopher? Black Republicans. Men who never did anything in their lives for the good of the common people. They’ve never realized that this country as a whole is no better off than the great masses of its people.”

The Fateful Fifth

Then they went to work on his wife. Unlike Henry, she was not involved in politics and her life revolved around her friends and social affairs. Her friends snubbed her and she no longer received invitations. She cried, she pleaded, she begged Henry to call off the ball park investigation and the lawsuit, when that did not move him, she threatened him with divorce. Henry began hitting the bottle.

On June 2, 1960, shortly after I published a detailed article by Lewis Lindsay called “The Giants Ball Park: A $15 Million Swindle,” the press broke the story that North had buried the hatchet with Christopher. In its first edition, the Chronicle correctly reported that North and Christopher had drunk a fifth and a half of Scotch together at Christopher’s home, and praised each other for publication. “He’s a great mayor,” North said—and agreed that legal entanglements were finished. The Chronicle dropped mention of the Scotch in later editions that went to most of its readers.

Cohn was outraged. “We had this suit won,” he told me. “North assured me he was going through with this no matter what happened. But they got to him through his wife, the poor old bastard. You see how they do things in this city? It’s so goddamned rotten you can’t believe it.”

When I called on North again, I found a complete transformation in his appearance. The look of a peppery fighter with ruddy cheeks had given way to a physical wreck; a baggy-eyed, tired, meek looking man weighed down by defeat.

The saddest part of the story was that his wife divorced him anyway. Not long afterward, North died of a heart attack. Harney died in December, 1962.

With North out of the way, with the daily newspapers blacking out the most important parts of the Candlestick Park story, with The Californian reaching only a few thousand citizens, it looked as though the scandal would never be investigated. In an effort to stir up something, I personally appeared before the Finance Committee of the Board of Supervisors and urged their help. One committee member, Al Zirpoli, had said before that he would favor an investigation.

No committee member challenged any facts I presented. When I finished, John Jay Ferdon, Committee Chairman, said only that he would not favor an investigation. He did not say why. (Six years later, when he had become District Attorney, he told me I was right about Candlestick.) Zirpoli, later to become a federal judge and the judge to hear draft resistance cases, said, “I agree with what Mr. Ferdon says.” He suggested, “If there is wrongdoing, your best course of action is a taxpayers’ suit.”

I went looking for wealthy liberals to finance a taxpayers suit, but none were in season. Cohn would have taken the suit if I could have found somebody to pay him for his time. All that he could do now was take me to business friends and introduce me.

The typical reaction came from Sam Cohen, owner of a plush restaurant on Maiden Lane said:

“Sorry, Burton, I can’t get involved. Do you know what Christopher can do to me with his power at City Hall? A Health Department inspector can find something wrong with this restaurant any time he wants. A door is too narrow, my stove does not meet regulations, anything to run me out of business. That’s how they do it. You can’t fight them.”

Since nobody in the city would fight, I asked Sen. Estes Kefauver, chairman of the Antitrust and Monopoly Sub-Committee of the Senate Committee on the Judiciary, to investigate. He replied: “As interesting as a study of how the San Francisco ball park deal took place would be, I do not conclude that it is a matter that should be gone into on the federal level. I think that it is entirely a local or state matter, and that the Subcommittee would perhaps be criticized if it moved into this area.”

Now Another Ballpark

Here we are eight years later, with a Candlestick Park that enrages so many people that a new mayor, Joe Alioto, wants to scrap it for a new stadium. His announced philosophy is that great public projects should not be waylaid just because all of the people aren’t getting enough spaghetti and zucchini. And no doubt many San Franciscans believe that a ball park is a great public project, greater than a school, housing complex or a modern transportation system. That attitude could be the most tragic part of this story.

YEAR IN FILM It’s tough to remember much of the ’90s — what with the air horns and kindercore, flannel and Flavor Flav — but I seem to recall Spike Lee giving the orders that seemed to finally, fully come to pass in 2013: “Make black film.”

Irony of ironies, when it seemed like so many black filmmakers were following through and doing just that — telling their communities’ stories, visualizing their own histories, and fearlessly unlocking troubling and painful key themes — Lee sidled away from Red Hook Summer, last year’s murky return to the fabled Brooklyn stomping grounds of 1989’s Do the Right Thing, and seemed to move toward a fallback position as actioner-for-hire with his redo of Park Chan-wook’s Oldboy, as if to prove that, testify, he can crush skulls just like his old Amerindie-boys-club rival Quentin Tarantino.

Yet isn’t Lee’s Oldboy a “black film” concerning unjust incarceration or bondage, as much as Steve McQueen’s 12 Years a Slave and Hunger are? Perhaps. The connections were in place, if you cared to look: the stasis of 12 Year‘s near-still opening shot, as Solomon Northup (Chiwetel Ejiofor) and other slaves facing the audience, waiting and listening to a white foreman’s directions, has its corollary in the multiple shots in Lee Daniels’ The Butler, of Forest Whitaker’s butler Cecil Gaines, face frozen. He’s the veritable “invisible man,” instructed to disappear into the background at White House dinners and forever listening for direction. And waiting — as if wondering when the moviemaking establishment will move on from its habit of bestowing statuettes for African American portraits in servitude, à la The Help (2011) and Driving Miss Daisy (1989).

It’s been a long time coming — much like a certain African American president that butler Gaines had waited a lifetime to meet. Five years into that presidency, the man who tried to “do the right thing” has, intentionally or not, changed the conversation on black representation on screens both big and small. The country’s ready to look at its past and break down the codes, whether they concern slavery, birthers’ loaded allegations about Obama’s “un-American-ness,” Paula Deen’s alleged workplace racism, or Julianne Hough’s wrongheaded Halloween costume — a blackface tribute to “Orange is the New Black” character Crazy Eyes.

This year’s contenders looked to not only historical role models like Jackie Robinson in 42 and Nelson Mandela in Mandela: A Long Walk to Freedom) — in movies made by white filmmakers — but also lighter, aspirational figures such as Tyler Perry (who laid siege on the box office with two efforts, A Madea Christmas and Peeples), as well as the glossy buppies populating popular comedy sequel The Best Man Holiday. Fans blew up the Interwebs with indignation when some misbegotten USA Today editor came up with the headline “Holiday Nearly Beats Thor as Race-Themed Films Soar.”

The Best Man Holiday is bourgie worlds away from Spike Lee favorite Fruitvale Station. (One wonders if the acclaimed indie will serve as a model for Lee’s own Kickstarter-fueled Trayvon Martin project.) Filling out the many shades of his protagonist’s story, and leading with cell phone footage of the fatal shooting, director Ryan Coogler never overplays the naturalistic narrative centered on Oscar Grant, so often writ larger than life all over Oakland in posters and street art. Though it was released at height of Martin-related outrage, the film keeps sensation and sentimentality at bay, apart from a foreboding scene of a stray dog’s sudden death. Like that hound on the run, Michael B. Jordan’s Grant is a driving, hustling, partying study in movement. Fully immersed in a multicultural Bay Area where racism operates in subtler and more complex ways than ever before, he, like any other restless rider, is just trying to get home.

Whitaker threw his weight behind Fruitvale Station as a producer — but his Gaines and The Butler seem wildly different on their stiff, sad surfaces. So much is simmering within Whitaker’s stocky form, his steadfast servant with access to power that he’s forbidden to use, and those blank looks. “We got two faces: ours and the ones that we got to show the white folks. Now to get up in the world, we have to make them feel non-threatened,” mentor Maynard (Clarence Williams III of The Mod Squad) offers. Surrounded by Daniels players like Mariah Carey and Lenny Kravitz, Gaines has one leg in a horrifying sharecropper past and another in upwardly mobile mid-century America, which filmmaker Daniels emphasizes by juxtaposing lynched black men with the stars and stripes at The Butler’s start.

The director goes on to unfurl his showiest stylistic flourishes in a series of jump cuts aimed at the spectacle of hypocrisy perpetually unfolding in the White House, as a table is carefully laid for a excruciating formal state dinner, and the Freedom Riders — Gaines’ son among them — are humiliated while staging a stoic sit-in at a Southern lunch counter. Passive resistance, in all its many forms, is the locus of both tragedy and heroism in The Butler.

Nature, with its dripping moss, strange sunsets, and even Biblical pestilence, provides brief snatches of beauty in 12 Years a Slave, as McQueen foregrounds the mechanistic business of slavery in the tools used for cutting cane, the wheels of a river boat. Free-born violinist Northup is beaten into a kind of tool after he’s kidnapped and sold into slavery. His body, nude and exposed to traffickers and buyers, is transformed into a commodity that doesn’t belong to him. His talents are also forced into new uses, as when he fiddles frantically while a mother is torn from her children in a horror-show of a salesroom floor — and later, during a torturous, late-night dance staged by Michael Fassbender’s damaged, sadistic slave owner. The effect of seeing familiar white actors (like Fassbender, and the stars who play The Butler’s various commanders in chief) reel by in a parade of status quo perpetrators, not saviors. In both 12 Years and The Butler, it’s disorienting — as if everyone in Hollywood is also aching to “make black film.”

Bridging McQueen’s explorations of physical and psychological abjection, Hans Zimmer’s slow-burning, string-laden score picks up where it left off in McQueen’s 2011 Shame, about Fassbender’s sex addict enchained to his confused desires. In terms of desire, it’s all too clear where Ejiofor’s Northup stands (“I don’t want to survive — I want to live!” he declares), and to his credit, McQueen makes his nightmarish 172-year-old descent all too relevant, especially at a time when the Obama administration addresses the persistent crime of human trafficking. It’s just a small leap of imagination to think of one’s story, name, and legal status blotted out and turned around by force and a gnawing “you’re nothing but a Georgia runaway” counter-narrative, reminding the viewer that no one is truly free when others are enslaved. *

School gaze

FILM At Berkeley, the latest documentary from the great Frederick Wiseman, runs 244 minutes — a time commitment intimidating enough to deter any casual viewer. But viewers intrigued by Wiseman’s long tradition of filming institutions (a small sampling: 1968’s High School; 1973’s Juvenile Court; 1985’s Racetrack; 2011’s Crazy Horse — the latter about a Parisian nude-dancing establishment) with fly-on-the-wall curiosity will want to carve out an afternoon for At Berkeley, as will those interested in 21st century educational issues, California’s financial crisis, and the care and maintenance of UC Berkeley’s free-spirited image, among other topics.

UC Berkeley students and grads also seem like a built-in audience, which means the film’s local screenings are likely to be more populated than they would be elsewhere. Folks who attended while Wiseman was filming (he shot 250 hours of footage over 12 weeks in what appears to be mid- to late-2011) might even catch a glimpse of themselves in crowd scenes and shots of casual moments on campus, which comprise the smallest portion of At Berkeley‘s divided interests. But the local-color moments do much to flesh out what’s not seen in the classroom and administrative-meeting sequences: the fading-hippie glow of Telegraph Avenue; two men with impressive yo-yo skills; a student tussling with his bicycle; a couple napping on a grassy expanse.

We’re also shown what goes into the maintenance of that postcard-perfect campus. Berkeley’s landscaping starts looking especially impressive when — during a retreat of school bigwigs that Wiseman had apparent free rein to shoot — one administrator points out that budget cuts mean the school employs just one person to mow all of its lawns. “Well, he’s doing a good job!” interjects Robert J. Birgeneau, chancellor of the school 2004-2013. At the time of filming, UC Berkeley was weathering a series of painful fee increases, staff furloughs and layoffs, and widespread budget cutbacks, with Birgeneau serving as its pragmatic, stern-yet-sympathetic eye of the storm.

Birgeneau, like everyone else in the film (including probably the most recognizable figure: former Clinton cabinet member Robert Reich, now a Berkeley prof), is never identified by name. At first, this feels disorienting; most docs strive to hook the viewer with first-act exposition, but At Berkeley simply plunges in with a woman (a teacher? a student?) regaling (a class? an extracurricular club?) with a myth about Berkeley’s origins (spoiler alert: it wasn’t founded by gamblers) that leads into a broader rumination on what the school represents. “A sense of imagination, of diversity,” she says. “An ideal.”

Before long, it’s obvious that we don’t need to know the back stories of everyone who appears in the film. This portrait of UC Berkeley — as a complex place, not without unrest, but also not without spontaneous a capella performances — emerges with all of its subjects sharing equal footing, their experiences and points of view presented with equal interest. Some of the most compelling scenes take place in classrooms, with remarkably articulate students (though, yes, Wiseman’s camera does catch a few looking sleepy and bored) discussing subjects as wildly diverse as poverty in America, advancements in robotics, Thoreau, and racism. There are also fascinating snippets of lectures, including an amusing, anecdote-heavy treatise from Reich on the importance of self-evaluation.

“The film has to work on both a literal level and a metaphoric, or abstract, level,” Wiseman writes in his At Berkeley director’s note. Filmgoers grasping for a through line will pick up on the financial stress that permeates every corner of the school. A student who describes herself as middle-class weeps at the financial burden she’s imposing on her parents. A professor advises a pair of eager students that their engineering dreams will require raising funds from government entities. Another professor expresses her concerns that increasing student fees will encourage new grads to seek out big paychecks to pay off their debts, rather than lower-paying jobs that might be more socially conscious.

The unrest percolating throughout the film culminates in coverage of a late-2011 Occupy Cal demonstration, in which the main campus library is overtaken by passionate protestors. The focus shifts away from the chanting students to UC Berkeley’s behind-the-scenes response, or rather, the phone calls and meetings that decide what the response should be (a “generic acknowledgement” is met by jeers from the protestors; a heavy police presence is suggested, but not visually documented).

In the library, a young man grasps the bullhorn and advises his fellow students that they need to organize their guiding principles more efficiently — an observation echoed later by Birgeneau. Unlike the headline-grabbing demonstrations that fill UC Berkeley’s storied past — its rabble-rousing legacy gets surprisingly few mentions here — there’s no underlying philosophy, he points out. A few moments later, we’re in a classroom, listening to students grumble about how the protests disrupted their midterms.

As its fourth hour draws to a close, At Berkeley‘s final sequence leaps from a discussion of one of John Donne’s sexier poems into a science class discussing interplanetary space travel. Sure, it’s possible, the affably geeky instructor says — but the practical concerns (like building a vessel with incredibly robust power sources that could sustain life for generations upon generations) tend to get in the way of one’s brilliant ideas and imagination. Here Wiseman’s affection for metaphor is made abundantly clear. *

Suspending judgment

In San Francisco public schools students can be sent home for talking back to a teacher, wearing a hat indoors, or sporting sagging pants. These infractions sound like the daily life of a kid, but the state calls them “willful defiance,” a category of suspensions that are nebulous to define at best.

Like the old saying about pornography, teachers say they know it when they see it, but students and parents alike are now calling foul on the practice.

The suspensions are so abundant in the San Francisco Unified School District that a movement has risen up against it. Sending kids home not only is an ineffective punishment, opponents say, it also can lead youth into the criminal justice system.

Now San Francisco Board of Education Commissioner Matt Haney is proposing a resolution that would ban willful defiance suspensions in San Francisco schools altogether.

“There will still be situations where we need to send a student home, but willful defiance will not be one of those reasons,” he told the Guardian. “Change is hard, complicated, and messy. But we can no longer deal with discipline or interactions with our students in that sort of way.”

He plans to introduce the resolution at the Dec. 10 Board of Education meeting, and if it passes, he said full implementation may take until the next school year.

There’s a fight to ban willful defiance suspensions statewide as well, but so far it’s been stymied. Just last month, Gov. Jerry Brown vetoed Assembly Bill 420, a bill mirroring aspects of Haney’s proposal. Those advocating for such a ban say it’s an issue of racial justice.

San Francisco’s African American and Latino students together suffer 80 percent of willful defiance suspensions, according to SFUSD data. The nonprofit student group Coleman Advocates for Children and Youth decried this statistic as an injustice, supporting the ban.

The San Francisco Board of Education took tentative steps to reduce suspensions as a whole in 2010, voting to introduce a new disciplinary system called Restorative Practices district wide. It’s complex, but basically asks students to talk things out in what are called “restorative circles” that include everyone involved in an incident, like a fight.

It’s also about changing the culture around discipline. It encourages teachers and students to establish a rapport, turning around the way some schools have practiced authority for decades.

At the time, there was hope. Fast forward three years, and that hope has dwindled.

Early evidence shows that Restorative Practices work better than suspensions, and prevent behavioral problems down the road, too. But out of SFUSD’s more than 100 schools, less than half of them started to implement the new reform.

Few schools have fully integrated the change, officials told us. Haney’s resolution addresses this with a mandate: SFUSD must implement Restorative Practices throughout the San Francisco school district.

The program is important, proponents say, because the majority of the 55,000 students a year moving through San Francisco schools still face school discipline that can set them way back in school and later may lead to incarceration. And suspensions can be levied for the smallest of infractions.

Cupcakes and justice

Xochitl is a 15-year-old SFUSD sophomore with long brown hair. She watches the TV show Supernatural (Dean is cuter than Sam) and yearns to one day live with her relatives in Nicaragua. Years ago on her middle school playground, she once faced a hungry child’s ultimate temptation: Free cupcakes.

The baked goods sat in a box on the cement by the playground, unattended. The frosting sat un-licked, the wrappers unwrapped.

She and her friend looked around, searching for a possible pastry owner nearby. Runners circled around the track in the distance, but no one else was around. The cupcakes met a satisfying fate inside Xochitl’s belly. The next morning went decidedly downhill.

As she walked into school, the counselor told her to go home: she was suspended.

“The cupcakes belonged to this girl because it was her birthday,” Xochitl said, something she found out only once she was being punished. “They went straight to suspension, they didn’t even let me speak.”

Restorative practices would have sat her with the birthday girl to explain her mistake and apologize. Maybe she would’ve bought the girl new cupcakes. That wasn’t what happened.

Suspended, Xochitl spent the day at her grandparents’ house. Not every suspended student has a safe place to go. Some turn to the streets.

In October a group of mostly black young students marched to the Board of Education to protest willful defiance suspensions. The group, 100 Percent College Prep Institute, formed in the ashes of violence.

“I drive a school bus for a living, and I had a boy on my bus who was not bad, but not good,” said 100 Percent College Prep Institute co-founder Jackie Cohen, speaking with the Guardian as she marched with her students. “When we got back from Christmas break, he wasn’t back on the bus. Turns out he decided to ‘live that life.’ Three days later, I found he was shot and killed.”

In some communities the jaws of crime and drugs are forever nipping at their children’s heels. A child inside school is safe. Suspensions throw the most vulnerable students into the wild.

“Preventing crime in San Francisco begins with keeping children in the classroom,” SFPD Chief Greg Suhr wrote in a letter to the SF Examiner last year. “Proactive policies, such as the ‘restorative practices’ implemented by the SFUSD, emphasize the importance of building positive relationships while holding kids accountable for their actions.”

Black students make up about 10 percent of SFUSD’s population, but they represented 46 percent of SFUSD’s total suspensions in 2012, according to SFUSD data. Latino students represented about 30 percent of suspensions.

The racial disparity of suspensions mirror the disparity of incarceration. A study by nonprofit group The Advancement Project found that in 2002, African American youths made up 16 percent of the juvenile population but were 43 percent of juvenile arrests.

Xochitl sees that with her own eyes every day.

“Some kids turn to the streets, you know. I’ve seen people younger than me go to jail,” Xochitl said. “I was on Instagram and saw a friend locked up. I knew that girl, she’s in my PE class.”

It’s one of our country’s many shameful open secrets. Nearly half of all adult men in the United States serving life sentences are African Americans, and one in six is Latino, according to data from the nonprofit group the Sentencing Project.

Fathers and sons, mothers and daughters, all trapped in a cycle of poverty to prisons that for some starts at school.

“As a school district, when that’s staring us in the face, we can’t not do something about it,” Haney said.

Sometimes it begins when students are still learning their ABC’s.

Bruises inside and out

Restorative Practices are implemented from kindergarten to high school.

“If [students] don’t have a sense of belonging… that’s going to prevent schools from addressing behavior,” Kerry Berkowitz, the district’s program administrator of Restorative Practices, told us. The seeds of mistrust are planted when students are young.

Desamuel could not yet spell the world “police” when he first met them.

He was five years old, and as kindergartners sometimes do, he threw a temper tantrum. In the school’s desperation to contain him, officials called the SFPD.

“The police only came one time,” Desamuel, now seven, told the Guardian. Sitting in his San Francisco home with his uncle Lionel, Desamuel sounded ashamed. “But I didn’t go to jail because they only put kids in jail for being bad, like kids taking guns to school.”

The memory angers Desamuel’s uncle, who feels restorative practices would have prevented the misunderstanding. His home is a testament to bridge building.

Lionel, his brothers and mother all pitch in to take care of Desamuel while the boy’s father makes what he calls “a transition.” The home is large by San Francisco standards. Drawings of Spiderman and Batman line the wall, equal in number only to the portraits of their family, most of whom live in the city. There’s a lot of care in Desamuel’s life. That hasn’t stopped his tantrums, though.

The family tried to get him therapy, psychological analysis, anything to help. But as any parent can tell you, sometimes a child just needs love.

Lionel struggled with the school’s administration, and asked them to try less punitive ways of handling his nephew. “I told them to just hug the boy. Their response was ‘it’s hard to hug someone swinging at you.'”

The last time Desamuel fought a student he was tackled to the ground by a school security guard. The now-second grader came home with a bruise on his face.

“When I was bad I hurted the children. I wasn’t supposed to get up, and couldn’t get up off the ground. He took me by the arms and legs,” Desamuel said.

The problem with outsize use of suspensions and punitive action, Berkowitz said, is that it breeds a fear of school that shouldn’t exist. Desamuel is no different.

“I got sent to the office and I had to go to the principal’s office and they talked about me being bad,” Desamuel said. “I think because I make too much trouble I have a lot of problems and they don’t want me to be there.”

Cat Reyes is a history teacher who is now a Restorative Practices coach at Mission High School. She said transformation in behavior is the whole point.

She told the Guardian about a student recorded a fight on film. The two fighting teenagers tried to let the incident go, but with the video online for all to see their pride came between them. If the school suspended the girl who recorded the fight there may never have been resolution. The wounds would fester.

But now the girl will join a restorative circle and explain her actions to those involved in the fight, and their parents. That’s far more daunting to kids than simply going home for a day, Reyes said. It doesn’t just stop at the talk though. “On one end she has to say sorry,” Reyes said. “But now she may go to the media center and create a [movie] about it on our closed circuit TV. The consequence fits the crime.”

As students talk out their differences enemies can become friends, she said. After all, the goal is to correct bad behavior and break destructive cycles. Yet less than half of the schools in SFUSD are employing Restorative Practices.

Slowly but surely

One of the biggest critiques of Restorative Practices is that it removes consequences. That’s the wrong way to look at it, Berkowitz said: “When people say consequences, they mean punishment. We want to work with students to find root causes.”

The numbers back her up: 2,700 SFUSD staff members have trained in Restorative Practices, according to data provided by the district. This consequently led to a strong reduction in suspensions, the district says, from more than 3,000 in 2009 to about 1,800 last year.

SFUSD recognized a good thing when it saw it, growing the Restorative Practices budget from $650,000 in 2009 to $900,000 in 2013.

But only about 25 schools started measurable implementation, Berkowitz said. She put it plainly, saying the program is in its infancy. “Are they ‘there’ yet?” she said. “No.”

“Our team is pretty maxed out,” she said. “To really bring this to scale and implement Restorative Practices, there’d need to be a lot of discussions around that.”

Asked how much she’d need to fully fund the program across all schools, she was evasive. Haney was more direct. When asked if his resolution tied funding to the mandate of implementing Restorative Practices district-wide, he admitted that a funding source hadn’t yet been identified.

“Mostly we hear there needs to be more: more support, more social workers, more people in schools to make this functional,” he said. “It’s a longer term challenge.”

That solution may emerge as the resolution goes through the approval process, but the program faces other problems besides funding.

Teachers have depended on suspensions as a tool for years. Money is one thing, but changing educators’ minds about discipline is another.

The “R” word

Martin Luther King Jr. fought for the integration of schools, but in a speech about Vietnam he said something that could apply to the SFUSD today.

“Life and history give eloquent testimony to the fact that conflicts are never resolved without trustful give and take on both sides,” the southern preacher said in one of his last speeches before his death.

There is one issue simmering under this entire debate, festering, unspoken. Why are black and Latino students suspended more than other groups? Is this system inherently racist?

It’s a tough question. Teachers are notoriously underpaid, overworked, under supported, and asked to enforce the newest policies at the drop of a hat. The teachers the Guardian spoke to all described a packed year filled with new methods to learn, all with a common purpose — a love of their profession and a love of their students.

“There’s a hesitancy to talk about race with this,” said Kevin Boggess, civic engagement leader for Coleman Advocates, the group leading the charge for the willful defiance ban.

Nevertheless the question of racism permeates the discussion. Xochitl felt persecuted as one of the few Latinas in a mostly Asian middle school.

In the case of Desamuel, the young black child who had the police called on him at age five, his uncle stressed the need for culturally aware teaching. Lionel said Desamuel was well-behaved when he had an authoritative, elderly black female teacher, but acted up in the hands of substitutes who weren’t black and whom he characterized as “young and new” to teaching. Then again, the principal who called the police to handle Desamuel was herself black.

Norm “Math” Mattox is a former James Lick Middle School math and science teacher, and he said from his perspective as an African American he’s seen the issues Haney’s resolution addresses clear as day.

“My sense is that teachers might be blowing the alarm a little bit too soon as far as their brown and black students are concerned, especially the boys. They don’t know how to manage them,” he said. In his experience, misbehaving children are sent out of the room too soon.

In the short term, suspensions are an expedient tool, but punishment without communication does long lasting damage. “The dynamic between teacher and student did not get resolved inside of the class,” he said.

One SFUSD school tackled the specter of racism head on. Mission High School is at the vanguard of what its principal calls “anti-racist teaching.”

Mission High has a higher African American student college placement rate than many SFUSD schools, a group that struggles to perform elsewhere. And as a designated “newcomer pathway” for new immigrants, the school has 40 percent English language learners.

Mission High’s principal, Eric Guthertz, is energized by the challenge. He revamped the way the school teaches to address race and ethnicity directly.

The geometry teachers use Bayview district planning data to illustrate mathematical lessons, and teachers look at grades by ethnicity and address disparities directly.

Guthertz credited Restorative Practices with lowering the school’s suspensions. SFUSD data shows Mission High’s steady suspension decline, with a 14 percent suspension rate in 2009, before the program started, and down to a 0.4 percent suspension rate by 2012.

“We’ve deeply embraced Restorative Practices,” he said.

Next week San Francisco will see if the Board of Education will take the same leap Gutherz did. As he is quick to point out, shifting the culture at Mission High School took years.

The Guardian contacted members of the school board, but did not hear back from them before press time to see how they may vote.

Either way, it’s time for SFUSD to change its ways, Haney said. But no matter what side of the matter you fall on, he said, it’s important to remember one thing.

“Everyone involved in this conversation wants to do better by these students,” he said.

The San Francisco Board of Education will vote on the ban of willful defiance suspensions and full implementation of Restorative Practices at their Dec. 10 meeting.

I asked vocalist-bassist Louisa Solomon about the band’s latest album, the causes that are most important to the Shondes, and how their music connects them with their fans:
 
SFBG Can you start off by telling me about your band’s name? I read that it means “shameful” in Yiddish.
 
LS We wanted to give a nod to our Jewish lineage, and to reclaim a word that is sometimes used to brand outcasts. At the time, we were doing a lot of activism in Jewish communities, challenging some deeply entrenched norms, and we would sometimes get screamed at and spat on and all that good stuff. It was kind of like, “OK, if I’m a ‘shonde’ for standing up for what I believe in, so be it.” I think it tends to be much more immediately resonant for Jews who have grown up hearing it, but the idea is resonant for most people in one way or another.
 
SFBG How would you describe your music to someone who has never heard it?
 
LS Sing-along, spirited rock anthems! The most flattering thing in the world is when our fans say we make them dance and we make them cry; that our music is hopeful. When we are able to impart hope, I feel totally fulfilled. So think of a Springsteen show and a riot grrrl punk show combining their emotional pay off, and that’s what we are going for!
 
SFBG What was the process of writing and recording The Garden like?
 
LS We worked really hard on The Garden. When we were touring on the previous record (2011’s Searchlights), we were starting to work through the musical and lyrical themes that came to define The Garden.

“Nights Like These” was one of the first songs we wrote in the Garden song cycle, and it felt like an important step in our evolution. We were embracing the cathartic potential of pop. We went on to write love songs, songs about friendship, and songs about not giving up. We wanted these songs to help people keep going – we were trying to ride the line between sincerity and cheesiness. I think we did OK in the end!
 
SFBG Can you tell me about “Nights Like These” and what made you choose it as the first single for this album?
 
LS “Nights Like These” is a good entry point to the record. We’re talking about hopes and dreams and fears and all that poppy stuff, but we really mean it! And there’s also serious musicianship and craft going on.
 
SFBG Is there a song from The Garden that you particularly enjoy performing?
 
LS I love jumping up and down during “Nights Like These,” getting the audience clapping along in “On Your Side,” and singing along to “The Garden” and “Nothing More Whole.” I also love singing “The Promise,” which is basically a duet with Eli, and we get the chance to camp it up just a bit.
 
SFBG Activism is an important factor in the band. Are there any causes in particular that you’re supporting right now?
 
LS We want a better and more just world, where people have what they need. So there are a billion causes we support! Big ones like universal healthcare, ending the Israeli occupation of Palestine, trans justice, but also we always want to support community organizers as much as possible, who are fighting racism and economic oppression (and tons of other great stuff!) at the local level. So we try to keep our eyes open.
 
SFBG What is the crowd usually like at a Shondes show?
 
LS Our fans are completely amazing and inspiring. There tends to be a lot of organizers who come out, and we have a growing number of older folks these days, which I think is awesome! Multigenerational fanbases rule. People who are mostly into punk and people who are mostly into pop and rock; people who are excited about the Jewish stuff and people who just love the music. Everyone tends to be enthusiastic and ready to dance. People very regularly tell us that they are moved by our playing (even to tears). It means a lot to us. It means everything.
 
SFBG What are you looking forward to most about playing in San Francisco?
 
LS It’s always wonderful to visit the Bay and play for our awesome people there. Cafe du Nord is one of our favorite clubs in the country; they have a totally heimishe (homey) vibe but are also extremely competent, respectful folks. It’s the best of all worlds as far as I’m concerned. Not to mention it’ll be my first Halloween in SF and I have seriously high expectations! Costumes, people.

Community not criminalization

OPINION San Francisco is poised to break ground in defense of immigrants, an important step towards turning the tide against the criminalization of communities of color.

In a unanimous vote on September 24, the Board of Supervisors supported a due process ordinance that, after final approval, will reduce deportations by setting strict limits on collaboration between federal immigration enforcement and local authorities. Our city will make history by refusing to implement the federal Secure Communities program, which allows US Immigration and Customs Enforcement (ICE) to request an immigration hold detention without cause, regardless of immigration status, at local expense.

This victory didn’t trickle down like fog from the “progressive Bay Area bubble.” It was hard fought, from the bottom up. Immigrant and undocumented people most impacted by the problems led the fight, and they built a movement too strong to ignore. Causa Justa::Just Cause helped organize the groundswell, as part of the San Francisco Immigrant Rights Defense Committee, a broad grassroots collaboration. We had support from progressive champions John Avalos, Eric Mar, David Campos, and five additional co-sponsors on the board.

This movement builds on the fights in the 1980s to make San Francisco a Sanctuary City, welcoming survivors of the wars in Central America. We build on the fights in the ’90s to re-commit to those values in the face of a new wave of migration, when economic refugees arrived, fleeing the hunger caused by US-imposed Free Trade Agreements. We build on the very personal fights of everyday people, like a woman we’ll call Silvia, a domestic violence survivor who met with the District Attorney repeatedly, demanded that he lead those meetings in Spanish so she could participate fully, advocated for herself and her community, and ultimately won his commitment of support for this ordinance. This victory belongs to the hundreds of community leaders who, like Silvia, overcame intimidation, organized their families and neighbors, and showed our elected officials the way forward.

In a national context, where states like Georgia, Alabama and Arizona hunt down immigrants, we in California, a majority immigrant, majority people of color state, have the opportunity, and the responsibility, to follow Silvia’s leadership. It’s time to reject criminalization, and build community.

Every time there’s a new way to label someone a “criminal,” more families and communities are torn apart. Millions of black and Latino people are behind bars already, thanks to criminalization policies like the war on drugs, structural unemployment, decades of divestment from working class communities, and racial discrimination. Creating new immigration violations only makes that problem worse, trapping whole new sectors of our society in the prison dragnet. This advance in San Francisco should inspire our state as a whole not only to reject S-Comm, but also to take bold action to address the profoundly problematic prison system, and challenge the racism and poverty it depends on.

But, for our state to stand up like that is going to take a serious transformation. Gov. Jerry Brown recently announced plans to expand the prison system with revenues from Prop. 30 — the grassroots progressive tax passed last year to support public schools and social services. Causa Justa::Just Cause, as part of California Calls, through SF Rising and Oakland Rising, was one of hundreds of community groups that helped pass this progressive tax. We are outraged to see the governor literally betting on the criminalization of the next generation, with money that was supposed to support their success.

Policies like S-Comm manufacture the need for more detention facilities, ultimately benefitting corporate interests like the GEO private prison group. Its lucrative business depends on criminalization, and a culture of fear. If politicians aren’t brave enough to survive the accusation that they are “soft on crime” in order to champion real change, then we the people will have to take it into our own hands. Immigrant communities, black communities, communities of color, and poor communities need to keep building the solidarity and the movement that will allow us to win, from San Francisco to Sacramento to DC. There is much more to be done, and we can only do it together.

Oakland’s Negative Standards support future punks

The band Negative Standards is essentially a crust art project.

While maintaining d-beat chords and sludge-like breakdowns, the Oakland-based group makes use of non-instrumental noise and videos created by the band’s bassist, Will, during shows.

And as a quartet that blends elements of crust, doom metal, and noise; Negative Standards sticks out like a sore thumb in the endless sea of fellow crusty brethren and fuzzy lo-fi that exists in the East Bay.

Anonymity is key for the band. Negative Standards sticks to Roman numerals in place of song titles and prefers not to have band members names attached to the project. While being interviewed, the guys chose to keep it on a first-name basis.

So, for housekeeping purposes, the band is as follows: Al on guitar, Will on bass/video, Max on drums and noise, and Will — who wasn’t interviewed — on vocals and non-instrumental noise.

According to Will, the choice to maintain anonymity is to let the music speak for itself.

“From the beginning, the idea was to present each recording as a coherent whole, rather than just a collection of unrelated songs, and doing it this way somewhat anonymizes the individual components,” Will says. “Another effect is that the lyrics, music and samples have to speak for themselves, not having been distilled into a name or a slogan.”

The band makes the conscious decision to only play all-ages shows to battle the age-old problem of gentrification in the Bay Area.

Drummer and non-instrumental noise creator, Max, expands on this idea: “Gentrification and the attendant cultural colonialism of bars and ‘the underground’ is threatening the existence of DIY all ages spaces in the East Bay more with each passing year,” Max says. “It makes sense that, as a band, we would want to resist the destruction of the cultural environment that has made our existence possible.”

Guitarist Al recalls going to Berkeley’s world-famous all-ages punk venue, 924 Gilman when he was growing up. Al believes that without all-ages venues such as the Gilman, bands like theirs would not exist. Everybody has a starting point, and Al credits the Gilman as his.

“If it weren’t for this place, I wouldn’t know most any of my current good friends, let alone be in this band,” Al says. “I think it’s important to support the future punks instead of shutting them out because you want to drink.”

The band credits the Bay Area for having a thriving scene with the likes of fellow bands such as Noothgrush,Permanent Ruin, Ordstro and Vaccuum. But like most to all existing punk scenes, there exists various isms.

“Seeing the amount of misogyny, transphobia, and racism that goes totally unchecked within some corners of our supposedly ‘radical’ scene can be pretty disheartening, but there’s also some incredible people working against those normative tides,” says Will.

Negative Standards, however, is leaving the sub-cultural hub of Oakland to embark on a European tour, playing with the likes of European punks Bacchus and Throwers.

“Vendetta Records from Germany put out our LP and hooked us up with Timo from Alerta Antifacista Records, who busted his ass to put this tour together for us,” Al  says. “I’m incredibly excited. I’ve never travelled in Europe before and am looking forward to it greatly.”

The band also has a split LP with doom band Whitehorse coming out on Vendetta Records in October.

Most of the band remains extremely cordial and modest, lauding other bands and the proverbial scene at large (for the most part). But as mentioned before, this band sticks out amongst others and Max is sure to break the tide.

“Fuck this false modesty,” Max says. “I defy you to name another local band that has both a totally gnarly wolf AND an outlandishly colored manatee on their van’s dashboard.”

You can catch this band at its upcoming going away show at the Oakland Metro. As the Oakland Metro site states, “no turds allowed.”

While Enrico Labayen is a respected choreographer on his own terms, he also has a curious and generous spirit, opening his Labayen Dance Company to other dance makers. For this program, jam-packed with two of his own world premieres in addition to rep work, he invited Anandha Ray to present her new Quimera Project for which she’ll bring a chorus of up to 30 tribal belly dancers. Additionally, two company members will debut pieces. Laura Bernasconi’s Nourishment and Hunger will draw on ballet, classical Indian Odissi, and acro-yoga. The Singularity

“Too Much Light Makes the Baby Go Blind”

Thirty plays in 60 minutes — that might sound like too much even for the most attention span-challenged theatergoers among us. Fortunately, the raucous Neo-Futurists troupe has been putting on the surreal channel surf known as “Too Much Light Makes the Baby Go Blind” for 25 years in its hometown Chicago, and for 10 in New York — where it’s won a celebrity cult following — so it’s got this thing down to an almost metaphysical science. A night of semi-improv performance (a timer is set and the audience yells out the titles of the plays to be performed from a “menu”) that whiplashes from affecting dramatic to absurdist comedy, with plenty of good-natured silliness thrown in, TMLMTBGB is like a strobe of emotions and situations — plates, buckets, ice cubes, wigs, and stuffed animals usually go flying, as do many preconceived notions of what theater ought to be. Death in June

Extremely depressing neofolk band Death in June is stopping by San Francisco for its long-awaited US tour. Initially starting as a post-punk, industrial project in the 1980s, the band shunned pretty-boy rock ideals, often donning ghoulish masks and costumes on stage. Death in June has given influence to plenty of contemporary bands such as metal band Agalloch and darkwave horde Faun, but the band isn’t without controversy of its own. It’s been known for using a skull, the totenkopf, synonymous with the Nazi movement. Often criticized for using SS insignia, the band has derided any and all accusations of fascism and white supremacy, being active in the British ’80s anti-fascist movement and playing in concerts such as “Rock Against Racism.” So back to the music: the group released Snow Bunker Tapes, guitar-backed versions of Peaceful Snow, on Neuropa this year. If there’s anything supernatural about the band Magic Trick, it’s in frontperson Tim Cohen’s seeming ability to be in several places at once. Darwin Deez

Darwin Deez is known for nutty antics like bringing a head of cabbage out onto the stage (as a “symbol of frugalness”) and chucking it at the crowd to eat. And his wriggly, emo-pop second album Songs for Imaginative People proved that he hasn’t forgotten about his equally nutty fanbase. His half-joking-totally-serious approach to songwriting garners a very unique brand of follower, the kind of person who likes things weird. The tracks on Songs aren’t as easy to swallow as those on his debut, self-titled album Darwin Deez. Tracks swing by in a cacophony of synthy beats and buzzing electric riffs and Deez’s frequently deadpan voice undeniably weaves through them in a disjointed way — adding a disheveled tone to the album. But from the silly and unpredictable misfit whose greatest obsession may be breakfast food, who’d expect anything else? (Smith)

Nearly 50 years ago, hundreds of thousands of people marched at our nation’s capital to demand racial equality and respect. And half a century later, people are still fighting for that same cause.

In July, when George Zimmerman was found not guilty of any crimes for fatally shooting 17-year-old Trayvon Martin, racial tensions flared in the Bay Area and abroad. Martin’s death brought the issue of racial profiling to the surface, energizing a new generation of activists just in time for Aug. 28, the 50th anniversary of the Great March on Washington and Martin Luther King Jr.’s “I Have a Dream” speech.

Rev. Arnold Townsend, vice president of San Francisco’s chapter of the National Association for the Advancement of Colored People, is a veteran of the Civil Rights Movement. Townsend told the Guardian that Martin’s death triggered memories of Emmett Till, a 14-year-old African-American who was lynched in 1955 for flirting with a white woman.

Townsend was 12 when Till was murdered, and he says seeing the pictures of Till’s disfigured body in a casket posted in Jet magazine was what inspired him to be actively involved in the movement for racial justice.

“What happens in the world finds ways of bringing people together. What happened to Trayvon Martin isn’t so different from what happened to Emmett Till,” Townsend told us. “I knew that people could come for my father, my uncle, but from this I learned that they could come for me.”

The Zimmerman verdict resulted in large demonstrations of anger and outrage all across the country, including Oakland and San Francisco. The verdict inspired Zack Aslanian-Williams, a 24-year-old San Francisco resident, and others to join the NAACP and become activists.

“There is something about the Trayvon Martin case that definitely impacted my willingness to get involved,” Aslanian-Williams told us. “The case caught fire, and I have a sense of urgency to get involved in any way I can.”

In the wake of the verdict, many new and veteran activists targeted National Night Out, a neighborhood watch program event that African American activists fear fosters the kind of racist vigilantism they say motivated Zimmerman to kill Martin.

Jesse Strauss and more than a dozen other Oakland residents fanned out all over Oakland during the Aug. 6 event, visiting dozens block parties in an attempt to educate people as to why they should be wary of police and wannabe cops.

“We’re doing this to build community and talk to people about real safety,” Strauss said. “I think that the way that police function has been steady, and from that we have so many black and brown people locked up. This is a reflection of the struggles that have been going on and this shows that racism has not stopped at all.”

Rev. Amos Brown, president of the San Francisco NAACP chapter, said he wants to see people come together around racial equality and he fears the targeting of neighborhood watch programs may hinder that goal.

“We don’t need extreme provocateurs,” Brown said of anti-police activists. “The movement is like an airplane, and if one wing is too heavy, the whole thing goes down”

But Brown is just as critical of police, saying the 52 hours of sensitivity training that all personnel at San Francisco Police Department have to undergo isn’t enough.

“If relations were good between them, we would not have numerous calls coming in from people who were profiled by police, immediately being asked if they were on parole when they were approached,” Brown said.

Many San Franciscans are sensitive to the racial profiling issue. Last year, when Mayor Ed Lee proposed a stop-and-frisk policy to combat the proliferation of guns — despite studies showing a similar policy in New York City disproportionately targets African Americans — the community rose up and forced Lee to abandon the idea.

“Being a person of color who has been racially profiled, I couldn’t stand back and let this happen,” says Theo Ellington, president of Black Young Democrats of San Francisco, which organized people against the idea.

But activists say it’s not enough to play good defense. Fifty years after the strong show of support for racial justice, there is still much progress to be made.

“We need to keep pushing forward,” Townsend said. “Success is not measured by what you have done, it’s measured by what you’re going to do next.”

On Aug. 24, the San Francisco chapter of the NAACP plans to head over to Mosswood Park in Oakland for a rally commemorating the march put on by the Coalition of Black Trade Unionists.

The University of San Francisco will also be hosting an event on Aug. 20 to discuss the progress and setbacks in the march toward racial equality since the 1960s. Speakers at the event will include Clarence B. Jones, Martin Luther King Jr.’s former lawyer and adviser, and Mayor Ed Lee.

“It’s important to pause and see what’s happened in the past 50 years. It is the 50th anniversary of the dream and it is important to recognize that there’s been some unraveling of the dream,” USF Vice Provost Mary Wardell-Ghiraduzzi said.

Ellington said he’s still waiting for his own generation’s Great March on Washington. “The death of Trayvon Martin was a wakeup call. It proved that my life, as a person of color, is not as valuable as my counterparts,” Ellington said. “We have to be the ones to turn the tide. There’s still a lot more work to do to fulfill Martin Luther King Jr.’s dream. We are still fighting the same social ills we faced 50 years ago.”

Trayvon Martin: Guns escalate conflicts

OPINION The tragedy of Trayvon Martin’s death is not merely the loss an innocent young boy’s life, nor the criminal justice system’s failure to provide justice, though those are wounds we struggle to bear. The tragedy is that these wounds are not unique. We have felt this pain before. Trayvon is but one of thousands of young African American men who have lost their lives to gun violence. And George Zimmerman’s acquittal represents the dismissive attitude our country seems to have about those lives.

People from all walks of life are angry about Trayvon’s death and George Zimmerman’s acquittal. Our anger in the face of such tragedy is understandable. I share it. But I also believe that even in our darkest hours, there is hope. There is something to be learned here.

Let this be the start of a greater debate on gun laws, racism, and our national climate of fear for our own personal safety and the safety of our children.

We have to do something about the prevalence of guns in our society. If not for the introduction of a gun into the situation, Mr. Zimmerman likely would have been beaten up—something he probably deserved—and that would have been the end of it. His firearm needlessly escalated the situation far beyond where it needed to go.

This case is a very real example of a nation that puts someone’s right to carry a handgun over someone’s right to not be pointlessly murdered. Let me add my voice to the multitudes calling for greater firearm accountability.

And why did the situation that night begin in the first place? “Neighborhood Watch” means “watch” and “report suspicious activity,” not “chase” or “pursue.” What is so suspicious about walking, wearing a hoodie, and talking on a cell phone? Nothing. Unless you are black.

Although the African American community is, sadly, used to being profiled, used to grieving the loss of our young boys and men to gun violence, Trayvon’s case has opened the eyes of others who are finally as outraged as we are. For the first time, I feel that something has changed. The outpouring of support from non-African Americans for Trayvon Martin and his family has given me hope that our cries for boys and men in our community are finally being heard.

Anger is a great motivator. And progress is often borne from tragedy. I hope for the African American community and for our country that this tragedy is more than just a passing media spectacle. I hope it’s the beginning of something meaningful, a reevaluation of gun laws, of the violence young black men face every day, and of the way we empower our communities.

Los Angeles’s Teatro Jornalero Sin Fronteras makes common cause with Santa Rosa’s the Imaginists

(Note: what follows is an extended version of a story and interview that appears in this week’s Guardian.)

A white passenger van pulls to the curb in a largely residential Spanish-speaking neighborhood in Santa Rosa, discharging a group of Latino men and women at the door of a converted warehouse. The visitors vary by age, class, and education. All hail from Mexico or Central America, but more recently Los Angeles, where they’re among the cities thousands of jornaleros, or day laborers, making their way job by job, often without secure documentation, or much security of any kind.
Standing beside the warehouse on this quiet street, they could be mistaken for an ad hoc work crew. But the warehouse is a theater, and this sunny afternoon in June is the culmination of a precious week off. Not that these men and women aren’t here in Santa Rosa to work — just this time it’s on a play.

Brent Lindsay and Amy Pinto, founders and artistic directors of the Imaginists, greet the visitors warmly as they collect outside the theater and slowly saunter in, joining other members and friends of the Santa Rosa company inside its spacious single room, together with their small children. The two groups have known each other barely a week, but already seem more than colleagues — more like extended family.

It’s the final day of a weeklong artistic exchange between the Imaginists and Teatro Jornalero Sin Fronteras (Day Laborer Theater without Borders), a Los Angeles–based Spanish-language ensemble theater created by and for the immigrant day laborer population. The ten-member troupe, founded in 2008 under the umbrella of LA’s Cornerstone Theater and led by co-artistic directors Juan José Mangandi and Lorena Moran, has so far created 15 short plays that they perform mostly at day laborer centers across Los Angeles — although this last year saw TJSF tour both Northern California and El Salvador. The plays examine everything from the legal and human rights of immigrant workers to health issues to the transnational cultures migrant workers share and foster.

After some socializing over a light breakfast of coffee and pan dulce, the two companies gather in a circle for some warm up exercises led by both Lindsay and Moran. One particular challenging memory game provokes mild frustration and laughter. “This is why we do this exercise,” explains Moran to her actors, all amateurs and volunteers united by the unique opportunities their theater has offered them. “We need to connect to another person and remember details about them.”

Then they all get back to work on a playlet they’ve been developing from improvisations. It begins with two workers who alternately pay off and slip by a snoozing guard (played by Imaginists company member Eliot Fintushel) to dump toxic waste into a nearby stream. When this causes an environmental disaster, a government spokesperson (played by Pinto) assures people in the audience that their organic produce is safe. Meanwhile, a cleanup crew of migrant workers is slowly poisoned to death. A news team rushes to the scene of the eco-disaster, but seems to take no notice of the brown bodies sprawled over it. Left alone onstage, the workers rise as ghosts — beginning with one who sings, “They’re carrying me off to the cemetery. Don’t anyone cry for me. Just sing my favorite song…” — and one by one exit the stage.

Throughout, Lindsay directs from a chair audience-side, giving advice or suggestions at various points. All, however, are welcome to chime in with comments and do. An elderly woman named Adela Palacios, for instance, suggests that before departing the stage each ghost can simply state their name and what they did for a living, a suggestion readily embraced by all. Soon the form of the scene has a solid arc, and the action gains many subtleties, as well as a tone that makes a virtue of the mix of amateur and professional actors. Combining slapstick, winking asides, an eerie sense of tragedy, and a moving use of direct address, it’s a surprisingly affecting bit of work.

“We come to the theater as older people,” explains Moran. “But we feel we’ve found a company [in the Imaginists] like us. We share the same path.” A native of Guatemala who worked in business administration before fleeing domestic abuse and the country, Moran (translated by Gustavo Servin, a young member of the Imaginists) speaks eloquently about the company she joined five years ago amid a dangerous working life that was both foreign and alienating to her. She acknowledges frankly, “Theater saved my life.”

TJSF is currently developing its first full-length play, Caminos al Paraíso (Paths to Paradise), written by Mangandi and directed by Moran. This exchange in Santa Rosa, made possible by a grant from the Network of Ensemble Theaters, has offered TJSF the opportunity to learn important technical aspects of crafting a full evening’s production from their more experienced colleagues. At the same time, it’s offered the Imaginists, which has grown into a bilingual company since rooting itself in Santa Rosa, a chance to advance their own mission through contact with a deeply community-driven Latino theater. But neither motive really captures the personal ties and mutual respect that have been forming here, the subtle and profound reciprocity of influence, and the solidarity emerging from it all.

“TJSF is a brave, important theater company that is telling stories that we don’t usually hear,” reflected Amy Pinto recently by email. “They tell them with humor, with heartache, in a group, in Spanish. Coming together for a week, we were able to strengthen our own resolve to tell these stories, not to be afraid of being deemed ‘political.’ For the Latino members of the Imaginists, the exchange was a catalyst to take ownership and be empowered by their histories and stories. This exchange reinforced how necessary it is to have comrades, to share experiences and methods, to have a network of support throughout the country for this work.”

The Imaginists plan to travel to Los Angeles for another face-to-face meeting with TJSF over next steps. Together they hope to develop something that can tour to labor centers across the country.

In the meantime, inspired by the exchange, the Imaginists are concocting a new play, based on a famous children’s story, which will address the plight of undocumented people. Working title: REAL.

“For Teatro Jornalero there is no division,” notes Pinto. “They are telling the stories of their lives. They are humanizing a ‘political’ situation. We have to let that sit in us, that uncomfortability — can we turn our politics off and on? No. Everything in art is a choice.”

She adds that the encounter held surprises for them too. “To have an encounter where all your expectations are turned upside down,” she marvels, “theater can do that. We are changed. There was so much laughter the entire week. And a fare share of tears.”

Voices from Teatro Jornalero Sin Fronteras

The following excerpts are from conversations that took place on Saturday, June 22, at the warehouse theater of the Imaginists in Santa Rosa. Members of the Imaginists and Teatro Jornalero Sin Fronteras had just completed their rehearsal, ahead of a public performance that evening, and were seated in a semi-circle to answer a few questions about their collaboration. Translation was provided by Julie Kaiser.

SF Bay Guardian Can I ask a general question of the members of Teatro Jornalero? Anyone who would like to answer please do. What brought you to the company, and why did you join? What does being in the company offer you?

Teatro Jornalero Sin Fronteras My name is Alberto Scareño. I found out about this when some of my friends told me about it. It was really interesting, so I called them up to see if there was a spot for me. They said, sure, come that day. And I went in. I’ve never been an actor. We started with exercises. It was really interesting and relaxing. Sometimes I have a lot of stress, or I’m just mad, and to come to this place that relaxes me — it relieves my stress, and time flies. Now what I hope for is to work with even more verve and learn more about the theater.

SFBG What kind of work do you do to make a living?

TJSF Every morning I go out and look for work at a corner in central Los Angeles. I’m a day laborer.

SFBG And you still find energy after a long day’s work for theater?

TJSF The deal is, I don’t get work everyday. So if I don’t work one day, then I have energy to go. When I work, I’m tired, but I get there, and I get my friends, and we do the exercises and I relax. And it’s fascinating.

SFBG Anyone else?

TJSF My name is Xico [pronounced “Chico”] Salvador Paredes. I was on a workers’ corner in California — I’d joined a battle to have a [day laborer] center made — and the first person that [I met] was Juan José. He had participated in theater as an actor, and he was starting to work on his play about illegals. Then he invited me and Lorena [Paredes is married to artistic director Lorena Moran], and other guys, to work in theater. At first I didn’t like it, because I’m a worker: I just get work, get work, get work — I’m not interested in anything else. I send money [home]. That was my only vision, to have a day of work.

But after I came in, I realized, it’s a weapon for communication and understanding, a means of connecting with other people. We started to create pieces out of our own experience, and to recreate our experience. It serves to take out of us what’s inside of us, and to let us know that we’re not alone. The best part of being in this theater is that we’re getting together with people who don’t know what a day laborer is. A day laborer stands on a corner. In the morning he’s cold. He doesn’t have anything to eat. He doesn’t have the security he’s going to actually get work. People walk by and say, “Oh what a lazy guy,” or they pass by as if you’re just a tree, because you’re just standing there all the time. Nobody understands what you’re doing standing there. But a day laborer has huge hope. And he doesn’t know if he’s going to get work. And that’s us.

With the theater, we’ve told many people about what a day laborer is, and shared with those who don’t know anything about their rights. Now we can say, “This is what it is.” It’s really difficult. I just got into a situation where I’ve gotten into the deportation process. I’m in the struggle, but I also have to go to court. I have to do lots of things. And I might get deported. I came here not just to work; I came here to tell my story. And my story’s big. No bigger than anybody else’s. But it’s very positive for people to hear: Here we are.

TJSF I’m Mario Rivera, and I’m very happy to be here sharing with you all. I’m also, like my friends here, a day laborer and I work in central Los Angeles. I came into the theater because I was invited by Lorena. What I like is learning from my compañeros. I had nerves when people looked at me, and I lost that. I lost that fear, and I really like being here. I’d like to learn more from everybody. And I like the play that we’re doing here [with the Imaginists]. This all suits me. I like all of this.

TJSF I’m Adela Palacios. And I’m not very good for talking. The reason why I’m in the theater is because I don’t have work. I studied nursing. Two times I graduated in nursing. I am a nurse. But I had an accident. Now I can’t find work. In this country there’s a lot of discrimination about age. I looked for work for two years. The only opportunity I’ve found, that opened doors for me without discrimination, was this theater. We are volunteers. We don’t have work. They help us. Sometimes they give us food. I am very grateful to this great person, Lorena. And I’m very grateful to Cornerstone Theater. We have some understanding there. We are not heard as we should be [in society], but they do a little, what they can. They give us a little bit of a normal life. My stress is better than it was. And they’ve done everything possible. They do what they can. They can’t do more. I’m really grateful. You have to accept what there is and not ask for much.

TJSF I’m Heidi Guevara. My problem is I have a fear of being in front of people. But now it’s gone. I didn’t think I’d ever do something like this, because I’m really embarrassed easily. Now I have the courage to be in front of people. Lorena gives us exercises. And they help you to use your voice and express yourself, to overcome your shame. It’s a little complicated, but I’m learning more little by little. And here we go! I’ve been with them one year — you have to keep learning and learning. You know this. You have to keep going and learning. Little by little, but I’m going. Thank you, Lorena.

TJSF My name is Raul Salinas. I’m from northern Mexico. Chihuahua. I have six kids. I’ve been ten years here. Now I’m in the Centro Jornalero for work. I don’t have full-time work. I’ve been with the theater three months. How did I get here? I don’t know. It was just chance. One day Lorena came to the work center. She came to do casting for a play that they’re doing called Ways to Paradise. I wasn’t going to do it. No. But there was another person who wanted to go and I helped him with directions to the place where they were doing the casting. And then I got involved. Now I’m involved with Ways to Paradise, about the problems facing migrant workers, explaining who we are, what we’re doing: Yeah, we’re undocumented, we’re from Central America, Mexico … I started thinking about the work, and I really like it. So I stayed. That’s it. There’s not much more to tell.

SFBG I’d like to ask Lorena: How did you become involved in the theater, and how has your relationship with it evolved over the years?

Lorena Moran I would like to tell you the story of Teatro Jornalero, how the project got created. In 2006, Michael John Garcés, the director of Cornerstone Theater, wrote a play called The Illegals. He went and did castings at all the day laborer centers. [Co–artistic director] Juan José [Mangandi] came out of that. He participated in the work, along with other workers from day laborer centers at the national level. And they were invited to a national congress of day laborers. One day they were bored, just hanging out. And Juan José said, “You know what? I have the script of The Illegals. Why don’t we just do a little piece of it and present it to the congress?” It was a marvelous idea.

We have lots of ideas that are marvelous. We need a reason to do it and we also need people to help us. Nothing is possible without that. This was a great idea of Juan José. And we got a lot of help from Michael Garcés and Cornerstone Theater. Roberta Uno of the Ford Foundation gave us our first grant, a big grant of several thousand dollars for two years. And right now, we’re working on a small grant of $25,000 for two years. It’s not much — it’s a big deal to maintain 21 people on $25,000. But it would not have been possible at all if we didn’t have these workers — gardeners, housekeepers, bouncers, day laborers, nurses — they all have stories and voices. And they can educate others, and educate themselves about the rules of this country, the laws, their status as undocumented people.

In 2008, I was invited to participate in a casting for the first company of Teatro Jornalero Sin Fronteras. We were 12 members, two directors. Ethan Sawyer, an American graduate of Northwestern, helped train Juan José, who didn’t know anything about the technical part of theater but had a big spirit for it. They helped us, and the other 12 members of the company.

And that’s how my story starts. I’d had just a year here. I’m from Guatemala. I suffered domestic violence; that’s something I don’t want to remember. They even have my three kids; they’re still there now. But I’m here. And I’m growing a better life. And my dream is that when I’m a citizen I can bring my kids here. But nevertheless, I’ve had five years in this country, and the theater saved my life. And if I’m well, I want my friends to be well, in spite of the traumas, the economic problems. I was this close to getting deported once. I was this close to getting deported once. I was working on a corner with my husband, Xico. I was working gardening, in construction, cleaning houses. I spent five months making six houses. Twelve men, one woman. I was the only woman building houses.

All that showed me the world of day laborers from the roots up. We’d get up at 5:00 in the morning and be standing next to Home Depot. And somebody would drive up and say, “I need somebody,” and we’d run. It was like trying to play the raffle. In my country I’m actually a business administrator. I have a university degree. It’s a totally different life. And there I am, standing on the day laborer corner. I’ve had to clean bathrooms, deal with sexual harassment, I’ve had to clean, and change floors out, and paint — it was a completely different thing for my life. And I realized this is the moment to find a sense of what it’s like to be a migrant. Separated from our families, from our countries; we’re not raking in money, we just want to live with dignity.

So we did a casting. We had some administrative help from Michael John Garcés. And I was named the managing director. It was a whole process. It didn’t happen immediately. But from the beginning I was a part of this group. There’s a moment when you’re present, and there’s a moment when you leave. I don’t know when I’ll leave. But I want people to love this group. We have a voice, and we have a story. We ourselves are part of this story, and we’re writing it.

For today, I’m grateful for my life, and I share with Brent and Amy and their group. I haven’t stop writing, because each day I want to get down every word that drops out of their mouths. For me, it’s part of my learning. That’s what this exchange is all about. We’re training in technical ways with a group that has a lot of similarity with us. They’re helping our community of day laborers and house cleaners. We’re talking. Not in the same idiom, but the same language. And I’m very grateful.

SFGB Can you say a little more about what it’s been like to work with the Imaginists?

LM This is a dream. It’s a dream. To think it all started those years again with Juan José and Sergio in Washington, DC. Juan José Mangandi, the other artistic director, he dreams all the time. He thinks of all these big ideas. For four years we’ve been looking for funds to do this. And we found a grant. And here we are. And we’re dreaming of a second one. We don’t know when or how, but we have a dream, we’re going to keep going, we want to build a network of theaters nationally in the same line as [Teatro Jornalero]. But even so, we have to talk more. This coming together now is a first pass.

We’re just dreaming — some groups in a bus, in a van, connecting with each other from different cities. We’re empowering our voice as immigrants with respect to the larger population of whites, African American, and other groups. This is the story that we have. We’re trying to remove the barriers to our opportunities. It’s huge that we came together.

SFBG What about for the Imaginists?

Amy Pinto For us, the kind of work we’re doing — in bringing Spanish and English together, the issues of the day laborers, and bringing people who are day laborers and professionals together to perform — sometimes the community doesn’t understand, and we’re not always supported. So you [Teatro Jornalero] coming here gives us strength. You teach us how to be strong and to come together to make this kind of work. I think for [Imaginists company members] Zahira [Diaz], and Sergio [Zavala], and Marcela [Mejia], and Gustavo [Servin], who is young, meeting all of you — they see the road then; and it can empower them to take more leadership.

Brent Lindsay It reminds us of why we do theater.

LM I have one question for Amy and Brent. How did it come about that two white people decided to come so close to our community, and do such magic things and help empower us? There’s migrants and Latinos — how did two white people decide to tell our stories, to live our stories?

BL There was a gentleman in the video that you showed. Close to the end, he said, I want to be proud of what I do in life. Like you, Lorena, theater saved me. And it became my religion because it saved me. My investment in theater now is the investment of human beings, what theater can give to others. Because what it did for us, that gift — now we should become its messenger. We have to invite every person into this art form. For the reasons that you’re finding: It heals us. It’s too easy to let fear divide us. We have to worker harder, to overcome fear and come together. Because so much of that fear is based on nothing. It’s nonsense. And the best way we learn that is to do what we’re doing now.

A conversation with co–artistic director Juan José Magandi [translation by Marcela Mejia]

SFBG Can you tell me about Caminos al Paraíso and your part in the production?

Juan José Mangandi As the dramaturg, I try to put the stories together in a cohesive way, drawing from the experience of the actors and my own — as a day laborer, as a community organizer, as an undocumented person. There was a lot of pressure of impose specific themes or stories, but in the end I put in what I felt was the most appropriate for the story as a whole. I was tempted to tell my own personal story, but I tried to tell the story of our community. it’s the first full-length play of Teatro Jornalero since I’ve been working with them, seven years now.

SFBG What was the starting point for this new project?

JJM I’ve worked for many years on behalf of day laborers, and have heard many stories, experiences, tragedies, dreams, songs. So Caminos al Paraíso is the story of the breakdown of connection, of what it feels like for people to lose their home, their town, their country. For example, Chronic Stress Disorder is something that affects many immigrants. Every time you cross a border, and then another, the syndrome grows worse. You don’t get rid of it. It manifests in the way you behave — in anxiety, fear, even the change in the diet has an effect, in addition to the intrinsic dangers that a journey like that implies.

So we speak about these things, so people know what happens when one cross the border, including the abuses on the Mexican side of the border. Everybody talks about the US and the racism and the discrimination of an imperialistic government, but what happens when our own people are the ones that are doing the discriminating? So the governments from Mexico and Central American countries say they want to protect the rights of our emigrants and yet they are often the first ones to commit abuses. So it’s a critique of the economic, political, and social conditions. It’s an industry, an industry of immigrants, not only here but there as well, where for the ones that benefit — the government, the traffickers, the narcos, everybody — it’s a business, it creates a lot of employment for people.

So there are a lot of tragic events that immigrants experience before they arrive in the US. And then what happens when we arrive in “paradise”? That will be the second half, and that’s a totally different story. We start to mix with other races, and we start to change. I mentioned already the diet, but also the culture, the values, the sense of belonging to a community, not necessarily a country. And chronic health problems can ensue. Many become bipolar or diabetic, suffer from high cholesterol, high blood pressure. It’s like the body is not prepared for all of this processed food. It’s a big shock physically, in addition to all the other aspects impacting the humanity of the immigrant.

We are escaping because we are old, victims of the corruption, the lack of opportunities. But we come here and there are no jobs really, and we don’t have a social identity — just the paper itself makes such a difference. It’s like being invisible. Besides doing dangerous work, we are also breaking with our cultures, with our identities, who we were and where we came from. Some people get really uptight about clinging to their past identities. It can become a big obstacle to making bridges to connection with each other, to understand each other.

SFBG Do you see the theater you’re making as a means of helping forge a new culture, bridging those divides?

JJM I think that the theater is a weapon of social struggle and transformation—not only for the people that are out in the audience but also for the actors themselves. The government teaches us about political borders, and then the poverty and the ignorance help us create another border, another barrier. We want to be different, we want to be better than the other, we want to separate form each other—a Salvadoran has to be better than a Mexican, a Mexican has to be better than a Guatemalan, and so on. For me, in my experience, the great problem is, and my big question is: Why can’t we integrate? This is what Teatro Jornalero is searching and striving for, to break these separations. We’ve had people from Cuba, Mexico, Salvador, Guatemala… Sometimes it gets heavy between the actors. There’s an inner racism. All of these themes that hurt so much, that we don’t want to talk about, are in Caminos al Paraíso. But then there is also a message for the community. That we should get ready to integrate. That we like this country. That we have adopted it as our own. Now we want them to adopt us as well, as members, and let us taste the good of this country so we can practice compassion for the ones that come after us.

Hi-yo, stinker

FILM Pop-culture historians who study 2005’s top movies will remember Mr. & Mrs. Smith, the so-so action flick that birthed Brangelina; Batman Begins, which ushered in a moodier flavor of superhero; and Tim Burton’s shrill Charlie and the Chocolate Factory.

That last title is of particular interest lately. Not only did Charlie provide grim confirmation that a post-Planet of the Apes (2001) Tim Burton had squandered whatever goodwill he’d built up a decade prior with films like Ed Wood (1994) and Edward Scissorhands (1990), it also telegraphed to the world that Johnny Depp — previously a highly intriguing actor, someone whose cool cred was never in question — was capable of sucking. Hard.

In the years since 2005, Depp hasn’t done much to stamp out those initial flickers of doubt. If anything, he’s fanned ’em into a bonfire. His involvement in the Pirates of the Caribbean franchise (which is plodding toward a fifth installment) has taken up most of his schedule, though he’s always willing to don a wacky wig whenever Burton needs him (2007’s Sweeney Todd; 2010’s Alice in Wonderland; 2012’s Dark Shadows). The rest of his post-2005 credits are a mixed bag, mostly best forgotten (ahem, 2010’s The Tourist), though one does stand out for positive reasons: 2011’s animated Rango, a cleverly-scripted tale that reunited Depp with Gore Verbinski, who helmed the first three Pirates movies.

The pair returns to Rango‘s Wild West milieu for The Lone Ranger; certainly there’ll be no Oscars handed out this time, though Razzies seem inevitable. The biggest strike against The Lone Ranger is one you’ll read about in every review: it’s just a teeny bit racist. The casting of the once and future Cap’n Sparrow — who apparently has a blank check at Disney to do any zany thing he wants — as a Native American given to “hey-ya” chants and dead-bird hats is very suspect. Some (white) people might be willing to give this a pass, because it’s always been part of Depp’s celebrity mythology that he’s part Indian. I mean, he totally has a Cherokee warrior inked on his bicep, just below “Wino Forever”!

Mmm-hmm. Let’s go to the source, shall we? Speaking of his heritage in a 2011 interview with Entertainment Weekly, Depp mustered the following: “I guess I have some Native American somewhere down the line. My great grandmother was quite a bit of Native American, she grew up Cherokee or maybe Creek Indian. Makes sense in terms of coming from Kentucky, which is rife with Cherokee and Creek.”

Sounds kinda sketchy, JD. The actor who played Tonto on TV may have been born Harold J. Smith (“Jay Silverheels” was his nom de screen), but he was also raised on Canada’s Six Nations reserve and was the son of a Mohawk tribal chief. So The Lone Ranger TV series, which ran from 1949 to 1957 — and had its share of racial-insensitivity and stereotype-perpetuating issues — was able to cast an actual indigenous person to play Tonto, but 2013’s The Lone Ranger, which elevates Tonto from sidekick to narrator and de facto main character, was not.

In fact, it’s not too far-fetched to assume that the casting of Depp (also credited as an executive producer) is the only reason this Lone Ranger exists. Clearly, he really wanted to play Tonto, and Depp has a way of making his performance the most important thing about whatever film he’s in. Were audiences really screaming out for The Lone Ranger, a rather literal big-screen take on a 1950s TV show with some heavily CG’d train chases added in? Could not $250 million, the film’s reported budget, have been better spent doing something … anything … else?

Obviously “redface” is nothing new in Hollywood. It was frequently deployed in the pre-PC era, as when a white actor played a heroic Native American figure — think Chuck Connors in 1962’s Geronimo. But shouldn’t we have transcended that by now? You’d never see blackface in a film unless it was being used to make a character look ridiculous (2008’s Tropic Thunder), or to make a satirical point, as with 2000’s Bamboozled. Somewhere, Kevin Costner is clutching his Oscars for 1990 post-Western Dances With Wolves — more or less cinema’s biggest mea culpa for all those “the only good Indian is a dead Indian” yarns of the John Wayne era — and weeping.

Tonto isn’t the only Native American character in The Lone Ranger. But the others (none of whom are given names, unless someone was called “set dressing” or “background actor” and I missed it) have a slightly sharper aura of authenticity than Depp, who spends the whole movie caked in either old-age make-up or campy face paint. They are mere plot devices, there to give contemporary audiences a reason to feel outraged when an evil railroad baron lays his tracks through their land and raids their silver mine. “Our time has passed,” an elderly Indian character tells the Lone Ranger (Armie Hammer, whose role literally consists of riding a horse and reacting to Depp’s scenery-chewing buffoonery). “We are already ghosts.”

But back up, kemo sabe. Racism may be The Lone Ranger‘s worst problem, but it’s not the film’s only problem. There’s also its bloated length (nearly three hours); its score, which dares to introduce an Ennio Morricone homage into a film Sergio Leone wouldn’t line his gatto‘s litter box with; its waste of some great character actors (Barry Pepper, William Fichtner); its assumption that having random characters ask the Lone Ranger “What’s with the mask?” over and over is the funniest joke ever; and its failure to follow through on its few inventive elements — that herd of Monty Python-inspired rabbits, for example.

And another thing: if the moral of The Lone Ranger — spelled out with all the delicate subtlety of a fiery train crash — is “greed is bad,” why did El Deppo sign onto this piece of crap in the first place? *

Distance and racism

Right now, I’m approximately 116 miles from the Mexican border.

When I was growing up, I was 1600 miles from the same border. I was in Boston–I had a discussion today with some musicians from Boston that are “alarmed” at “the end of America” because of “amnesty”. When I pointed out that in the last 24 years, LA had become more “Latino” (I sussed out that the issue wasn’t illegal immigration as it never really is, when they started in with “press 2 for English”) and that crime and pollution was down and land values up–might as have been talking to my toenails.

I think it’s the same syndrome that crazy white folks in gated communities have about “the end of our way of life”–the further removed they are from the actual human beings that terrify them the more terrified they are.

Why do you think Coeur D’Alene, in Idaho’s northern tip was the capital of white power, hundreds of miles away from non whites?

It’s race.

The end of the Republican Party

Everyone knows and loves the expression “out of the mouths of babes”, but I doubt that’s the reaction this poll got in the halls of Republican power. Apparently (and not surprisingly) younger Americans of all stripes don’t like the GOP.

Before you sputter away with “another lib poll”, this one comes to us from the Winston Group and the College National Republican Committee. Despite attempts at rebranding and spiffy stabs into high tech, the general consensus among Millenials is that Republicans are generally “closed minded, rigid, racist and old fashioned.” In related news, water is wet, the Bay Area is foggy and Justin Bieber’s career longevity is unlikely.

As marketers and businessmen of any political ilk will tell you, if you don’t get the young to buy what you’re selling, attrition is gonna wipe out your sales. As political analysts will also tell you, voting patterns are set young and when voters vote three straight elections a certain way, they tend to ossify.

The Republican Party is in a major league bind. Having relied on the “Southern Strategy” of racial resentment since 1964 when it made numerical sense (that is, not many minority voters) and now having to change and fast (30% of the electorate will be non-white in 2016), what can they do? Race is their glue. But as a twenty something today has spent most of their life among all kinds of people and is no longer isolated, racism’s zing is ineffective.

And on economic issues, they do just as badly. The poll tells us that younger voters are far more savvy and realistic than the “I know I’m gonna win the lottery” jackalopes whose sinuses seem glued to Fox 24/7. Poll says that they realize that unless they become wealthy or end up at the top of a big business does the GOP care about them. Which means they are astute enough to realize that not only are the odds against them, but they’re stacked in favor of the scions of inherited wealth. 

That these people are all under 30 and are savvy enough to grasp what their supposedly wiser elders refuse to believe tells me that what I have believed for over 20 years about the Right is plainly obvious–economic conservatism and belief in the pseudo “free market” sense is really tied to the idea of privilege. In the “natural order of things”. But if you’re on the outside looking in and know it, playing to this sentiment is a loser–which means that the supposedly naive kids are a lot more intuitive than their parents.

Put plainly and simply, it’s impossible to persuade someone that the mythical 50’s were better than now, if the person and question has no connection to that era, save a few minutes of Weezer’s famous Happy Days spoof. The invocation of “good old days” only reminds kids that their inflexible, narrow-minded reactionary elders aren’t living in the here and now. Not a winning strategy ever for anyone.

The “Do Nothing” Solution to “Illegal Immigration”

Both sides of the political aisle have made a major issue out of the problem of the 11 million people inside the US illegally or presently undocumented. The president has said this is a priority and Florida senator Marco Rubio has agreed. They are theoretically opposed to each other, yet Rubio’s proposals entailed in the Border Security, Economic Opportunity, and Immigration Modernization Act of 2013 don’t differ a great deal from Obama’s. In a nutshell, Rubio has suggested that the wholesale eviction of 11 million people is impossible and that the bill offers them an opportunity for legalization and permanent residence and citizenship. Naturally, the “jump through hoops” process begins here: Fines and background checks and no federal bennies.

Sounds completely reasonable, but you’d think Rubio had suggested that the government was handing out lollipops and bon-bons, making Spanish the new “official language” and changing the “Star Spangled Banner” to “Guantanmera” by the reaction of his “conservative” peers. A cursory Google reveals an enraged base represented by such intellectual heavweights as Townhall.com and Ann “To Hell With Palin, I Was Here First” Coulter. Any concessions to the teeming masses of south of the border is treasonous amnesty and in their hardly humble opinions, this will lead to “de-Europeanization” (ie less white).

As far as what the generally pitiful Democrats are offering, it is only marginally different than Rubio’s idea. Which is also reasonable, but overlooks the crux of the issue, because no one anywhere has to unmitigated gall (until now) to say it: “Illegal Immigration reform” is a solution in search of a problem, because in reality, it isn’t a problem at all!

The way I see it, a problem means an aggrieved party and in this instance, there isn’t one. People want to hire help for whatever the task is, other people agree to do it for a price, end of story. The idea that “illegal immigrants are stealing American workers jobs” sounds fairly solid on its face unless you happen to live in the American Southwest and notice that wherever day laborers congregate, there aren’t a whole hell of a lot of white folks. As far as “taking away jobs that union carpenters/plumbers/electricians do”, isn’t it the union’s job to protect their own for one and for two, a skyscraper isn’t built and wired with dudes from the Lowe’s parking lot. It is not worth a major contractor’s license to screw with E-Verify (I passed an E-Verify check myself a few months ago for my radio show!).

Assuming you “legalized” every man, woman in child in the US tomorrow, what happens? The working person’s price rises. Which means that they will be replaced by new people from Central America or Asia that will remain invisible. See, we are a free country with open borders–people can come and go as they please, this isn’t a gulag (yet) (The irony of the most virulent anti-USSR voices being the loudest for a border fence is astounding). Not only is there no way to stop it, there isn’t even a real reason to stop it–as China and Japan might tell you, an aging and shrinking worker base is starting to hurt them and hard.

Fact is, both major political parties support and oppose it for a pair of reasons of their own. Democrats love this, as it accelerates the “Bluing” of the Southwest with millions of new voters beholding and grateful to them, making a Republican national electoral victory mathematically impossible. The other reason they love it is because it replenishes their most loyal and organized base, labor. Republicans hate it for two reasons as well–newly legal workers will have more rights, bargaining power and higher pay, which means that a new cheap labor era is gonna take a while. The other reason is the one they vehemently deny but is as obvious as the honkers on their maps–their base’s great unifier isn’t economics or even social issues, but race. That the Dixiecrats of the last century are now almost entirely Republican. The glue that holds them intact, whether they’d care to admit it or not, is white supremacy. And a sea of legal Americans that are a deeper shade of soul galls them to the cores of their rancid selves. Were they serious about “sending all of these people back to where they came from”, they’d boycott every and any business that employs them, which means they’d pretty much have to stop eating. I’ve seen what the average reactionary looks like--that ain’t happening.

In fact, when the “illegals” are white, they say nothing.

Obama and Rubio both cry out that the system is “broken” but it isn’t. Undocumenteds pour billions into the coffers of state and federal and don’t get it back and whatever their costs are to health or schools, they’re balanced off by what the public saves in lower food and service costs. They’re a wash. Which means that any changes to the laissez-faire system only make everyone’s life harder and more complex. If there is a solution, the easiest one would be a “seven year rule”–you prove you’ve actually been here 7 years, no criminal record, you take a citizenship test, that’s it. 

We have undocumented people in this very neighborhood. They want the same things we do. That’s good enough for me.
