Out of downtown

It wasn’t going well for Ted Strawser, predictably. The alternative transportation activist faced an uphill battle March 14 trying to convince a San Francisco Chamber of Commerce committee to endorse Healthy Saturdays, a plan to ban cars from part of Golden Gate Park.

Representatives of the park’s museums and Richmond District homeowners had just argued their case against the measure. “Visitors want access to our front door, and we want to give it to them,” Pat Kilduff, communications director for the Fine Arts Museums of San Francisco, indignantly told the group of two dozen business leaders gathered around a large conference table.

Strawser gave it his best shot: he talked about following the lead of other great cities to create car-free spaces; he said, “Golden Gate Park is one of the best parks in the nation, if not the world”; and he made a detailed case for closure. But around the table there were scowls, eye rolls, and other obvious signs that Strawser was being tolerated, not welcomed. Some — including chamber vice president Jim Lazarus — even started to interrupt and argue with him.

Then the man sitting next to Strawser spoke up. “I don’t think this is fair,” he said. And suddenly, everyone in the room shaped up. Strawser’s ally — his only supporter in the room — was somebody no chamber member could or would dismiss. Warren Hellman doesn’t shout or bang the table — but when he speaks, downtown pays attention.

Hellman, a prominent investment banker, told the committee members that he expected them to show the same respect for Strawser that they had for the previous two speakers. The nonsense ended, immediately.

And by the time Strawser turned the floor over to Hellman, the mood had changed. The group listened raptly, smiled, and nodded as Hellman spoke in his usual folksy, familiar, disarming style.

“It’s not a lot of fun when friends fall out,” he began, “because the previous speakers and many of you all agreed on the necessity of the garage [that was built in Golden Gate Park], and we worked together.”

He pointed out that many in the group had promised during the fall 2000 election to support Healthy Saturdays once the garage was built, although Hellman was now the only member of the coalition honoring that commitment. But he didn’t chide or shame his colleagues. That isn’t Hellman’s style.

Instead, he spoke their language. The garage has never been full and needs the money it can charge for parking to repay the bonds. This isn’t a fight that’s going away, since “part of the conflict is because this park is everybody’s park.” But there are “about 100 compromises not acceptable to either side that would move this forward.” And if a solution can’t be found, there will probably be an expensive ballot fight that nobody wants.

“My conclusion is we should attempt this test,” Hellman told the group. Ultimately, when the vote was later taken in secret, the chamber didn’t agree, although it did vote to back a trial closure after the California Academy of Sciences reopens next year.

At the meeting, Hellman openly called for Mayor Gavin Newsom to get involved in seeking a compromise, something Hellman said he had also just requested of the mayor at a one-on-one breakfast meeting. A couple of weeks later Newsom — who had already indicated his intention of vetoing the measure — did broker a compromise that was then approved by the Board of Supervisors.

As usual, Hellman didn’t take credit, content to quietly play a role in making San Francisco a better place.

Healthy Saturdays isn’t the most important issue in local history — but the significance of Hellman’s involvement can’t be underestimated. His alliance with the environmentalists and park advocates might even signal a sea change in San Francisco politics.

Warren Hellman represents San Francisco’s political and economic past. And maybe — as his intriguing actions of recent years suggest — its future.

This guy is a rich (in all senses of the word) and compelling figure who stands alone in this town. And even though his leadership role in downtown political circles has often placed him at odds with the Guardian, Hellman consented to a series of in-depth interviews over the past six months.

“Our family has been here since early in the 19th century, so we had real roots here,” Hellman told us. His great-grandfather founded Wells Fargo and survived an assassination attempt on California Street by a man who yelled, “Mr. Hellman, you’ve ruined my life,” before shooting a pistol and barely missing.

The Hellman family has been solidly ruling class ever since, rich and Republican, producing a long line of investment bankers like Warren.

Yet the 72-year-old comes off as more iconoclast than patrician, at least partly because of the influence of his irreverent parents, particularly his mother, Ruth, who died in 1971 in a scuba-diving accident in Cozumel, Mexico, at the age of 59. “She was entirely nuts,” Hellman said, going on to describe her World War II stint as a military flier in the Women’s Auxiliary Service Pilots and other colorful pursuits. “She just loved people, a little like I do. She collected people.”

Hellman grew up wealthy and cultured, but he also attended public schools, including Grant Grammar School and Lowell High School. In between, the young troublemaker did a stint at San Rafael Military Academy — “reform school for the rich,” as he called it — for stunts such as riding his horse to Sacramento on a whim.

After doing his undergraduate work at UC Berkeley, Hellman got his MBA from Harvard and went on to become, at the age of 26, the youngest partner ever at the prestigious Manhattan investment firm Lehman Bros. He developed into an übercapitalist in his own right and eventually returned home from New York and founded Hellman and Friedman LLC in San Francisco in 1984, establishing himself as the go-to financier for troubled corporations.

“He is really one of the pioneers of private equity,” said Mark Mosher, a longtime downtown political consultant and the executive director of Gov. Arnold Schwarzenegger’s California Commission on Jobs and Economic Growth, on which Hellman sits.

Hellman became what Business Week called “the Warren Buffett of the West Coast,” a man of extraordinary wealth and power. Among other accomplishments, Hellman took Levi Strauss private, recently made billions of dollars in profits selling DoubleClick to Google, and manages the assets of the California public employee retirement funds (CalPERS and CalSTRS), which are among the largest in the world.

Like many financial titans, Hellman has always been a generous philanthropist, giving to the arts, supporting schools in myriad ways, and funding the San Francisco Foundation and the San Francisco Free Clinic (which his children run). He vigorously competes in marathons and endurance equestrian events, often winning in his age bracket. And he has his humanizing passions, such as playing the five-string banjo and creating the popular Hardly Strictly Bluegrass festival.

But he’s also been a prime facilitator of downtown’s political power, which regularly flexes its muscle against progressive causes and still holds sway in the Mayor’s Office and other city hall power centers.

Hellman founded, funds, and is a board member of the Committee on Jobs, which is perhaps the city’s most influential downtown advocacy organization. Hellman and his friends Don Fisher, the founder of the Gap, and Sen. Dianne Feinstein also started SFSOS, which now wages the most vicious attacks on left-of-center candidates and causes.

When the de Young Museum and other cultural institutions were threatening to leave Golden Gate Park, Hellman almost single-handedly had an underground parking garage built for them, in the process destroying 100-year-old pedestrian tunnels and drawing scorn from the left. The Guardian called it “Hellman’s Hole.”

“We at the Bike Coalition very much started out on the opposite side of Warren Hellman,” San Francisco Bicycle Coalition executive director Leah Shahum told us. “We couldn’t have been more like oil and water on the garage issue.”

But over the past two years or so, Hellman’s profile has started to change. He went on to become an essential ally of the SFBC and other environmentalists and alternative transportation advocates who want to kick cars off JFK Drive in Golden Gate Park on weekends, crossing the downtown crowd in the process. He has shared his wealth with progressive groups such as Livable City, which often fights downtown, and has stuck up for edgy fun seekers over more conservative NIMBY types. He has also publicly repudiated the attacks of SFSOS and its spokesperson, Wade Randlett, and withdrawn his support from the group.

Hellman is still a Republican, but a thoughtful and liberal-minded one who opposed the Iraq War and wrote an article for Salon.com in February titled “If the United States Were a Company, Would George Bush Be Our CEO?” (His answer: hell no.) And to top it all off, Hellman sports a few tattoos and even attended 2006’s Burning Man Festival and plans to return this year.

Unguarded and reflective, Hellman’s comments to the Guardian foreshadow the possible future of capitalism and influence in San Francisco and point to potential political pathways that are just now beginning to emerge.

Our first conversation took place at the Guardian office two weeks before the November 2006 election, when it was starting to look like Nancy Pelosi had a good shot at becoming speaker of the House of Representatives.

“I think this election in two weeks is going to be really interesting,” Hellman told us.

This Republican was cheering for the Democrats to win. “They aren’t my kind of Republicans,” he said of the people in power. Hellman didn’t support the war or approve of how the Bush administration sold it, and he wanted Pelosi and the Democrats to hold someone accountable.

“What I’d like her to do is admit that we can’t get out [of Iraq immediately], but start to talk about what the fallout has been. Discuss the enormous cost in human life as well as money, and how it’s possible the war united the Middle East against us,” Hellman said.

The one thing he can’t abide is disingenuousness. Hellman speaks plainly and honestly, and he asked us to keep particularly caustic comments off the record only a few times during almost six hours’ worth of interviews. He was self-effacing about his political knowledge and seemed most interested in working through the problems of the day with people of goodwill.

Asked what he values most in the people he deals with, Hellman said, “It’s authenticity. Do they believe things because they believe in them, or do they believe in things because they’re cynical or they’re just trying to gain something?”

Locally, Hellman has reached out to people with varying worldviews and come to count many friends among those who regularly battle against downtown.

“I love to know people,” he said. “That’s probably the single thing that motivates me. When someone says to me, ‘How can you be friends with [then–head of SEIU Local 790] Josie Mooney?’ I say, ‘Look, I want to know Josie Mooney. And if she’s awful, then we won’t be friends.’ I’m just fascinated by getting to know people. And virtually always, they’re a little like Wagner operas: they’re better than they sound.”

Hellman was the chair of the Committee on Jobs when he got to know Mooney, who chaired the San Francisco Labor Council and was a natural political adversary for the pro-business group, particularly when Hellman was leading the fight to do away with the city’s gross receipts tax, which has proved to be costly for the city and a boon for downtown.

But after that victory, Hellman turned around and cochaired a campaign with Mooney to retool and reinstate the gross receipts tax in a way that he believed was more fair and helped restore the lost revenue to the city.

“We lost, but he put $100,000 of his own money into that campaign,” Mooney told us, noting that the proposed tax would have cost Hellman and Friedman around $70,000 a year. “I think he just thought the city needed the money. It was a substantive point of view, not a political point of view.”

Mooney considers Hellman both a friend and “an extraordinary human being…. He has made a huge contribution to San Franciscans that doesn’t relate to ideological issues. A tremendous thing about Warren is he’s not ideological, even in his political point of view…. On politics, I’d say he is becoming more progressive as he understands the issues that confront ordinary people.”

Mooney is one of the people who have helped bring him that awareness. When they first met, Mooney said, Hellman told her, “You’re the first union boss I ever met.” That might have been an epithet coming from some CEOs, but Hellman had a genuine interest in understanding her perspective and working with her.

“In a sense, I think that was a very good era in terms of cooperation between the Committee on Jobs and other elements of the city,” Hellman said. “Josie and I had already met, and we’d established this kind of logic where 80 percent of what we both want for the city we agree on, and 20 percent [of the time, we agree to disagree].”

Committee on Jobs executive director Nathan Nayman — who called Hellman “one of my favorite people in the world” — told us that Hellman feels more free than many executives to be his own person.

“He’s not with a publicly held company, and he doesn’t have to answer to shareholders,” Nayman said. “He takes a position and lives by his word. You don’t see many people like him in his income bracket.”

Hellman has become a trusted hub for San Franciscans of all political persuasions, Nayman said, “because he’s very genuine. He’s fully transparent in a city that likes to praise itself for transparency. What you see is what you get.”

Hellman expects the same from others, which is why he walked away from SFSOS (and convinced Feinstein to bolt as well) in disgust over Randlett’s scorched-earth style. Among other efforts, SFSOS was responsible for below-the-belt attacks on Sups. Chris Daly, Jake McGoldrick, and Gerardo Sandoval (whom a mailer inaccurately accused of anti-Semitism).

“If all things were equal, I’d just as soon that SFSOS went away,” Hellman said. “SFSOS started doing the opposite of what I thought they would be doing, so it was fairly easy for me to part company with them. What I thought we were doing is trying to figure out ways to make the city better, not just being an antagonistic, nay-saying attack organization. I’m not a huge fan of Gerardo Sandoval, but I thought the attacks on him were beyond anything I could imagine ever being in favor of myself. And it was a series of things like that, and I said I don’t want anything more to do with this.”

Downtown, they’re not always quite sure what to make of Hellman.

“Every once in a while, he does things that irritate people who are ideologically conservative,” Mosher said. “He took an immense amount of heat for supporting the Reiner initiative [which would have taxed the rich to fund universal preschool].”

He’s given countless hours and untold riches to public schools, doing everything from endowing programs to knocking on doors in support of bond measures and often pushing his colleagues to do the same.

“My connection to him has been through the school district, and he’s really been a prince,” Sup. Tom Ammiano said. “He has even stopped calling me antibusiness. He put a lot of his energy into improving public education, and so he shows it can be done.”

Progressives don’t always agree with Hellman, but they feel like they can trust him and even sometimes win him over. “If you get a relationship with him and you’re always honest about the facts and your own interests, he will listen, and that’s pretty remarkable,” Mooney said. “He shows a remarkable openness to people who have good ideas.”

His appreciation for people of all stripes often causes him to reject the conventional wisdom of his downtown allies, who viciously attacked the Green Party members of the Board of Education a few years ago.

“Everybody said, ‘Oh my god, Sarah Lipson, you know, she’s a Green Party member, she’s the furthest left-wing person on the board,’ blah, blah, blah,” he said. “And I phoned her up one day and said, ‘I’d really like to meet you.’ And she’s — leave aside the fact that I think she’s a very good person as a human being, but she’s a very thoughtful, analytic person. Listening to her opinions about things that are happening in the school district, I really respect that. I mean, what do I know about what’s going on in the school district? I know more now than I did then. But just getting to know people, and maybe get them to understand my point of view, which isn’t that penetrating.”

Many of his efforts have received little publicity, as when he saved the Great American Music Hall from closure by investing with Slim’s owner Boz Scaggs and helping him buy the troubled musical venue. “There are things that you and I don’t even have a clue that he has done,” Nayman said.

“He’s an interesting guy,” Mosher said. “He’s one of a dying breed, a liberal Republican. He has a social conscience and wants to use his money to do good.”

Actually, calling Hellman liberal might be going too far. In the end, he’s still very much a fiscal conservative. He doesn’t support rent control, district elections for the Board of Supervisors, taxing businesses to address social problems such as the lack of affordable health care, or limits on condo conversions.

He also opposes the requirement that employers provide health care coverage, which downtown entities are now suing the city to overturn, telling us, “In general, I don’t think it’s a good idea, because I’m still, even in my aging years, a believer that the marketplace works better than other things…. Universal health care I do believe in, but what I worry is that it’s going to be another damned bureaucracy and that it’s not going to work.”

Yet he doesn’t believe wealth is an indicator of worth, saying of his fortune, “It is luck. Most of what you do you aren’t better at than everyone.”

He doesn’t believe in the law of the jungle, in which the poor and weak must be sacrificed in the name of progress. In fact, he feels a strong obligation to the masses.

As he told us, “My mantra for capitalism — and I didn’t invent this, but I think it’s pretty good — is that capitalism won, and now we need to save the world from capitalism.”

Hellman looms large over downtown San Francisco. His Financial District office offers a panoramic view of the Bay Bridge, Treasure Island, the Ferry Building, and the rest of the city’s waterfront. He likes to be personally involved with his city and the companies in which Hellman and Friedman invests.

“Usually I’m directly involved,” he told us in an interview earlier this year. “I’ve always said that I don’t like to go to the racetrack to just look at the horses. The fun of being a principal is that you’re standing at the track and not saying, ‘Gee, that’s a beautiful gray horse.’ You’re saying, ‘Come on, he’s got to win!’ So I’m almost always invariably invested in the companies that we work with, either individually or through the firm.”

Unlike many Wall Street barons who strive to control a company and bring in new executives, flip it for a quick profit, or liquidate it, Hellman said his firm tries to identify solid companies and help facilitate what they do. “We don’t usually take over companies. I always think that we provide a service to help the businesses,” he said. “Our job is kind of the opposite of owning a factory. Our job is to be sure the people who run the business feel like it’s their business.”

Similarly, he thinks capitalists need to feel a sense of ownership over society’s problems, something he thinks is taking root in San Francisco and other economic centers, particularly among the younger generations. “It’s about understanding how much suffering there is on the other side and trying to figure out how that suffering can be alleviated,” he said. “I think it’s partly good economics that as you bring people up, they’re able to do more for society. If nothing else, they’re able to buy more and shop at a Wal-Mart or something — probably someplace you would wildly disapprove of — and buy goods and services. But I don’t think it’s that narrow.”

Rather, he believes that everyone has a little progressive in them, a little desire to cooperatively solve our collective problems rather than pass them off to future generations. He sees a marked change from his days at Lehman Bros.

“Everybody was into making it,” he said, noting that many capitalists then did charity work as a means of attaining social status but focused mostly on the accumulation of wealth. But, he said, the new generation of capitalists seems genuinely interested in improving the world.

“The feeling for giving back in the next generation, in the now 25- to 35-year-olds, it’s just an order-of-magnitude difference than it was for people who are now in their 40s and early 50s,” Hellman said. “I’m very encouraged.”

Yet the flip side is that, in Hellman’s view, downtown doesn’t wield as much power as it once did. Low political contribution limits have made politicians less dependent on downtown money, creating fewer shot callers, while democratizing tools such as the Internet have broadened the political dialogue.

“For the last 30 years we have become an increasingly tolerant city, and that’s great,” he said. “In the old days, [the Guardian] complained about downtown, and yeah, no shit, downtown really did control the city. The benefit was as that slipped away, the city became fairer and more open to argument. So now downtown hardly has any power at all anymore. In a sense, that’s a good thing. Tolerance grew tremendously when the city wasn’t dictated to.”

That tolerance caused street fairs to pop up all over town and festivals such as Hellman’s Hardly Strictly Bluegrass to blossom in Golden Gate Park. Bike lanes have taken space from cars, events such as Halloween in the Castro have gotten crazier, street protests have gotten bigger and more frequent, and people have felt more free to fly their freak flags. And all that freedom eventually triggered a backlash from groups of isolated NIMBYs who complain and often find sympathetic ears at city hall.

“Sometimes you get the feeling in this city that in the land of the tolerant, the intolerant are king,” said Hellman, whose festival has endured noise complaints even though the music is shut off by 7 p.m. “There is a continuing pressure to do away with fun, because fun is objectionable to someone, [but] we need to think about not creating a new dictatorship of a tiny group of people whose views are not in line with the opinion of most of the people of San Francisco…. You should try to balance the good of a lot of people versus the temporary annoyance of a few people.”

Preserving fun and a lively urban culture is a personal issue for Hellman, who plays the five-string banjo and calls his festival “the most enjoyable two days of the year for me.” He helps draw the biggest names in bluegrass music and acts like a kid in a candy shop during the event.

“I feel very strongly that an important part of our culture is built on the type of music and type of performance that goes on at Hardly Strictly Bluegrass,” Hellman said. From parables set to music to songs of struggle and the old union standards, “that kind of music is the conscience of our country.”

He considers bluegrass a vital and historically important form of political communication, more so than many of the upscale art forms that the rich tend to sponsor. “I’m glad that we have first-rate opera, but it’s equally important that we foster the kind of music, lyrics, etc., that support all this,” he said. “Somebody once said that most of the great Western philosophy is buried in the words of country songs. And that’s closer to the truth than most people think. A big passion of mine is to try to help — and people have defined it too narrowly — the kinds of music that I think have a hell of a lot to do with the good parts of our society.”

Perhaps surprisingly for a Republican venture capitalist from the older generation, Hellman also considers the countercultural freaks of San Francisco to be some of the “good parts of our society.” That’s why he attended Burning Man for the first time last year and why, he said, he loved it, as much for the culture and community as for the art.

“I went to Burning Man because as much as possible I want to experience everything,” he said. “I want to just see directly what it’s like. I knew I’d enjoy it. I never doubted that. But what really overwhelmed me is it was 40,000 people getting along with each other. I mean, it’s pretty intense. There were dust storms and the world’s most repulsive sight: nude men over 70 just dangling along. But I never saw an argument. It was 40,000 people just enjoying each other.”

It was most striking to Hellman because of the contrast with the rest of society. As he said, “I’ve never seen this country so divided.”

While Hellman supports Schwarzenegger — calling him “a good advertisement to California” — he has nothing good to say about his fellow Republican in the Oval Office. He calls Bush’s tenure “an absolute four-star disaster.” The invasion of Iraq is the most obvious problem, he said. “Our war policy has slowly veered from being ‘Don’t tread on me’ to we’re going to jump on your neck.”

But his antipathy to certain aspects of the Republican Party began even earlier, when the religious right began to take over.

“I thought we were not that polarized during the Clinton administration. I was somewhat encouraged,” Hellman said. “Maybe there was an undercurrent of strident religious behavior or strident conservatism, but not the conservatism that I think the Republican Party used to stand for, which was fiscal conservatism instead of social conservatism. Somehow, there was this angst in this country on the part of religious people who I guess felt this country was being taken away from them, and they were the kind of stalwart or underpinnings of society. And they took it back.”

But in the wake of that disaster, Hellman thinks, there is an opportunity for reasonable people of goodwill to set the future political course. As Nayman said of Hellman, “He does believe there is a middle way pretty much all the time.”

Politically, that’s why Hellman gravitates toward the moderates of both major parties, such as Schwarzenegger and Newsom. He looks for people who will marry his economic conservatism with a regard for things such as environmentalism and social justice.

“It’s very tough to be a big-city mayor,” Hellman said. “[Newsom is] probably the best mayor we’re entitled to. He’s got this fantastic balancing act.”

Hellman said downtown hasn’t been terribly happy with Newsom for supporting striking hotel workers, getting behind Ammiano’s health insurance mandate, supporting tax measures, and generally letting the Board of Supervisors set the city’s agenda for the past two years.

“Their measure is he has 80-percent-plus popularity, and he ought to spend some of it. Well, they might not agree with what he would spend it on. And he’s been unwilling to spend very much of it. In some parts of the business community there is disappointment with him, but I don’t think that’s right. He didn’t hide what he would be like.”

What Newsom said he would be — a big reason for his popularity — is a mayor for the new San Francisco, a place where the city’s traditional economic conservatism has been tempered by a greater democratization of power and an ascendant progressive movement that expects its issues to be addressed.

“I don’t like people who are intolerant,” Hellman said. “I don’t like people that are telling you something to get some outcome that, if you understood it, you probably wouldn’t want. I like people that are passionate.”

Asked, then, about Sup. Chris Daly, the nemesis of downtown and most definitely a man of strong political passions, he said, “I admire Chris Daly. I disagree with Chris on a lot of things he believes, but there are also probably a lot of things I would agree with Chris on. And I respect him.”

Hellman is the rare downtown power broker who wants to bridge the gap between Newsom — whom he calls a “moderate to conservative establishment person” — and progressives such as Daly, Mooney, and the Bicycle Coalition. The middle ground, he said, is often a very attractive place, as it was with Healthy Saturdays.

“I’m sure you spend time in the park on Sunday, and it’s a hell of a lot nicer in there on Sundays than Saturdays,” Hellman said. But even more important to him, this is about integrity and being true to what Golden Gate Park garage supporters promised back in 2000.

“They were proposing Saturday closing at that time, which I’ve always thought was a good idea,” he said. “And we made a commitment to them, or I thought we made a commitment to them, that let’s not have Saturday closure now, but as soon as the garage was done, we’d experiment with Saturday closure.”

We brought up what Fine Arts Museums board president Dede Wilsey has said of that pledge, that it was under different circumstances and that she never actually promised to support Saturday closure after the garage was completed.

“There’s a letter. She put it in writing,” he said of Wilsey. “She signed a letter on behalf of the museums saying that when the de Young is done, we should experiment with Saturday closings.”

The Bike Coalition’s Shahum said that even when Hellman was an enemy, he was a reasonable guy. But it’s in the past couple of years that she’s really come to appreciate the unique role he plays in San Francisco.

“He showed decency and respect toward us,” she said. “We never saw him as a villain, even though we disagreed completely. Later he really stepped up and has been a leader on Healthy Saturdays. And what I was most impressed with is that he was true to his word.”

Supervisor McGoldrick, who sponsored the measure, echoed the sentiment: “Hellman was certainly a man of his word who acted in a highly principled way.”

So why does Hellman now stand apart from the downtown crowd? Has he parted ways with the economic and cultural power brokers who were once his allies?

No, he said, “I think they parted ways with me.” *

Tucked away among craggy cliffs, patches of sand, and some of the Bay Area’s best scenery, a nude beach is the last thing you’d expect to find within a short walk of the end of Geary Boulevard. But on warm days, Land’s End usually draws dozens of visitors.

HOW TO FIND IT Go to the end of Geary, and park in the dirt lot up the road from the Cliff House. Take the trail at the far end of the lot. A hundred yards past a bench and some trash cans, the path narrows and bends, rises and falls, and eventually becomes the width of a road. Don’t take the road on the right, which leads to a golf course. Instead, keep going past another bench, and as the trail turns right, take a left toward a group of dead trees. Where there’s a stairway with a Dogs Must Be Leashed sign, descend and head left to another stairway, which leads to a 100-foot walk to the cove. Alternately, follow the service road below the El Camino del Mar parking lot a quarter mile until you reach a bench, then take the trail there. It’s rough in spots, and at the end you’ll scramble over rocks.

THE BEACH Rocks and little watery grottoes. Look for some good sandy areas away from the beach’s entrance. For the best sunbathing spots, walk west (left). Some visitors build little rock windbreaks, which provide protection from blowing sand.

THE CROWD The quarter-mile-long cove gets up to 30 visitors on the warmest days, with up to 80 percent gay male usage being fairly standard. One visitor counted six or so nudes, all men, during a May visit.

PROBLEMS Long walk, random "sex patrols" by rangers, reports of drug use, public sex on trails and nearby. Fog and wind. Quite rocky. Swimming not allowed. Trails other than the main one are unsafe and may be closed and have poison oak.

GOLDEN GATE BRIDGE BEACH


Overrun by fans undeterred by its slippery and often dangerous trails, the Golden Gate Bridge Beach usually turns into a mob scene on summer weekends. The waves don’t break as hard here as at Baker Beach, so on the nicest days in low tide, you can go out up to 50 yards. A favorite activity: watching the sunset while staring toward the site’s namesake, the Golden Gate Bridge. But don’t visit if you’re looking for privacy and solitude. "I had to stop going there because it’s such a pickup scene," frequent visitor Joseph Friday says.

Also known as Nasty Boy Beach and Marshall’s Beach, the shoreline here features a trio of adjacent coves. In the spring, check for beautiful flowers on the bluffs. Drawbacks include some poison oak on the path (often trimmed back by volunteers), which is otherwise unmaintained and becomes a muddy bluish goo after rainstorms. Golden Gate National Recreational Area rangers strongly recommend that visitors stay away from the trails and avoid swimming.

HOW TO FIND IT Go to North Baker Beach, park in the main lot, and walk north along Lincoln Boulevard, passing the sand ladder that leads to North Baker. Just north of the ladder trail, look for a dirt road with a gate leading to Battery Crosby. Follow it, then hike up the trail immediately on the south (left) side of the old fort to the top of the bluff. Rangers recently added some rails that make the path a little easier to follow. Take the trail straight west as it goes downhill toward the ocean (wear long sleeves and pants to protect against poison oak). At a small crumbling concrete bulkhead, the trail heads north along the bluffs and eventually down a shorter, steep section with small steps cut into the gully. The main path ends at the south end of Golden Gate Bridge Beach.

THE BEACH Three small rocky beaches located below Fort Winfield Scott. The main beach trail tends to be slippery, heavily eroded, and dangerous.

THE CROWD During the week, Golden Gate Bridge Beach attracts dozens of users. On weekends, (mostly nude) usage soars to between 100 and 300 visitors on the hottest days.

PROBLEMS Slippery, crumbling, sometimes muddy, and poison oak–edged trails. Trash, rocks, wind, fog, unsafe swimming conditions, sex on the beach, too many people often jammed into too little space.

DEVIL’S SLIDE


Now that its main access road, landslide-prone Highway 1, is finally reopened, visitors are flocking back to one of California’s only state beaches that officially permit nudity. Called Gray Whale Cove State Beach, the site known to many users as Devil’s Slide draws maybe 200 people on warm days — about 25 percent of them nude.

Nude use is especially popular on the north end of the long sandy shore. If you like Frisbee, it’s easy to find somebody to play with at the cove. Signs, though, warn about dangerous surf. There’s no lifeguard on duty. Dogs are prohibited. The beach is open all year and is one of the only California state parks that doesn’t accept an Annual Day Use Pass.

HOW TO FIND IT From San Francisco take Highway 1 south through Pacifica. Three miles south of the Denny’s Restaurant in Linda Mar, turn east (inland, or left) on an unmarked road, which will take you to the beach’s parking lot, from which a 146-step staircase leads to the sand. Coming from the south on Highway 1, look for a road on the east (right) 1.2 miles north of the Chart House restaurant in Montara.

THE BEACH A 300-foot-long site surrounded by orangish sandstone cliffs on one side and the beautiful Pacific Ocean on the other. Devil’s Slide is a great place to read, tan, jog, play Frisbee, and watch (true to its state beach name) gray whales, pelicans, and surfers.

THE CROWD Tourists, families, surfers, and naturists all use the beach.

PROBLEMS Influx of suited visitors, cold water, fog, wind, long walk to the beach. Landslides sometimes close Highway 1, three great white sharks seen in the ’80s. Parking fee. Some sexual activity reported in north cove area in recent past. Rangers have made a few arrests.

SAN GREGORIO


A visit to San Gregorio combines history with recreation. Approaching its 40th anniversary, clothing-optional, privately run San Gregorio is America’s oldest nude beach, founded right next door to San Gregorio State Beach, where nudity is not allowed. The huge property attracts some nude and suited straight couples, singles, and families. First-timers are sometimes a bit put off by the driftwood structures on the sandy slope leading down to the beach, which are used by some visitors as sex condos. Others relish San Gregorio’s scenery. There are two miles of soft sand and tide pools to explore, as well as a lagoon, a lava tube, and, if you look close enough on the cliffs, the remains of an old railroad.

HOW TO FIND IT From Tunitas Creek Way, south of Half Moon Bay, the beach is about a mile up Highway 1. Around 100 yards north of Highway 84 on 1, take the dirt road past the big white gate with the Toll Road sign. Go a few hundred feet, and just after the 55 mph sign on your right, turn left on the dirt road (look for the address 19429 above the fence) and head past a grassy field to the parking lot, where you’ll be asked to pay an entrance fee. Take the long path from the lot to the sand; everything north of the trail’s end is clothing optional. The beach is also accessible from the San Gregorio State Beach parking area to the south; from there hike about a half mile north. Take the dirt road past the big white gate with the Toll Road sign to the parking lot.

THE BEACH You’ll find caves, cliffs, driftwood structures, and a beach full of clean, rolling sand. Pets are OK (though dogs are not allowed on weekends or holidays); fires, cameras, and overnight camping are banned. Swimming is not recommended. There are toilets in the parking lot.

THE CROWD On the warmest days, 50 to 200 visitors may be spread along the sprawling beach, which is so large that it never feels crowded. Straight couples and families tend to hang out on the south end of the beach, gay men on the north side.

PROBLEMS Fee, wind, riptides, cold water, summer fog, sex on the beach or in driftwood condos, not much of a social atmosphere. *

It just doesn’t feel like summer without a trip to the pool. Marco Polo, chips and soda, suntan lotion on your face, pushing your brother in the deep end — it’s all a part of your balanced, nutritious summertime experience. But don’t fret if you don’t happen to have a lap pool on the roof of your railroad apartment. If you’re looking to splash it up, get the kids some swim lessons, or just do a few laps, there are plenty of great, inexpensive opportunities at one of your municipal aquatic chill spots — made by the people, for the people. Here are some of our favorites.

San Francisco

The San Francisco Recreation and Park Department’s Aquatic/Swimming Programs (www.sfgov.org) have a life’s worth of swimming activities just waiting for you. The city’s nine pools offer pregnant and senior swim programs, lessons for infants, competitive workouts, and even synchronized swimming lessons with the SF Merionettes. And SF community pools are cheap: $1 for children 17 and under, $4 for adults, and $20 for a 10-swim scrip ticket for seniors and those in economic need.

BALBOA POOL


If you’re using public transit, Balboa Pool is the most easily accessible. It’s walking distance from Balboa BART, the J line, and the 26 Valencia, 9 San Bruno, and 43 bus lines.

Wondering why a city slicker would want to cross the bay for a pool? King offers one thing SF pools don’t: a five-day junior lifeguard program, which teaches kids first aid, CPR, and life-saving rescue techniques for $68.

Nothing is what it seems in Red Road, a wonderfully restrained thriller that marks the feature debut of British writer-director Andrea Arnold. Jackie (a fierce Kate Dickie) works as a surveillance camera operator, studying closed-circuit feeds streaming from Glasgow’s streets. Her life is mysterious without being spectacular; for one thing, she lives alone but wears a wedding ring. Clearly, she’s had a tragic past, and her present is haunted by the specter of unfinished business – but what, exactly? And who is the mysterious man (Tony Curran) she pursues after spotting him on one of her monitors?

"The feedback I’m getting is that a lot of people don’t work it out exactly until the end," Arnold told me over the phone from Canada, where we missed meeting at the 2006 Toronto International Film Festival. "I do sometimes think, ‘Oh god, was I too subtle?’ "

Being too subtle is a problem more directors should have. Arnold’s gift for capturing complicated characters and gritty urban settings was first displayed in Wasp, her 2003 Oscar-winning short film. In it impoverished young mother Zoe (Red Road costar Nathalie Press) parks her unsettlingly large brood in the parking lot of a pub after she determines it’s high time for a child-free date night. Near-tragedy ensues, but through it all Zoe remains sympathetic, not pathetic, despite the questionable decisions she makes along the way. This quality is shared by Red Road‘s Jackie.

"I knew I was taking things far by her behaving in a way that you didn’t completely understand. That was a risk of people running out of patience [with her]," Arnold said of Jackie, whose aloof demeanor makes her actions, including hooking up with a man she apparently hates, all the more surprising. "I think it takes a while to get to know her. But I like characters that are not so easy or straightforward."

Arnold’s interest in complex characters brings depth to her stories, which on the surface seem to simply follow the daily lives of rather ordinary people. "I think all human beings are very complicated in their circumstances and their environments – sometimes people don’t always behave in the best way. It doesn’t mean to say that they’re bad," she said. "I like seeing people that may not be easily likable to start. But then when you get to understand them more, when you see them in a more three-dimensional way, then you at least understand them, or you have empathy for them rather than immediately making a judgment about them."

Though she fielded suggestions to turn Wasp into her first feature, she was set on Red Road – even after she won the Oscar. It’s the first product of Advance Party, a concept project in which three directors will make films featuring the same group of characters, but each with distinct stories.

"Zentropa [cofounded by Danish director Lars von Trier] and [Scotland’s] Sigma Films had the idea of making films with rules, a bit like the Dogme films. Zentropa were very much involved in the Dogme thing. They were looking for filmmakers who hadn’t made a feature film before, and they saw Wasp when it premiered at the Edinburgh Film Festival," Arnold recalled. "They rang me up, and it went from there."

Danish filmmakers Anders Thomas Jensen and Lone Scherfig sketched out the characters, who are required to appear in all the films and be played by the same actors. Arnold and the other two Advance Party participants – Dane Mikkel Norgaard and Scot Morag McKinnon – cast together and discussed story lines that each would pursue, but the films are stand-alone narratives in which "the other directors are free to create their entire universe."

Red Road‘s universe is bleak enough even before Jackie explores its seedier pockets, first through TV screens and then by physically visiting the places she’s seen on video. The surveillance theme is a nod to classic cinema (think Rear Window, The Conversation) and the information age.

"I’ve read we’ve got 20 percent of the world’s cameras in the UK," Arnold said. "There’s a lot of CCTV – it’s kind of a fact of life in this day and age. But my character uses it in a way that people are not supposed to use it. It’s supposed to be a crime-prevention tool; you’re not supposed to be following people. But who wouldn’t be tempted? I find just watching people fascinating, people going about their lives and doing ordinary things. I find it riveting." *

April has been an exceptionally busy month for the artists at the Hunters Point Shipyard. In addition to dusting off work spaces in preparation for the upcoming Spring Open Studio, the 300-member colony is scrambling to track the implications of Mayor Gavin Newsom’s ever-shifting effort to keep the 49ers in town, particularly as it affects the artists who have rented space at the base for 30 years.

Newsom’s latest proposal involves building a football stadium in the shipyard rather than at Candlestick Point. That’s likely to displace a group that claims to be the largest colony of artists in the nation – unless the mayor can find a place for them in his hasty plans.

"Hellzapoppin’" is how shipyard artist Marc Ellen Hamel described the recent flurry of redevelopment-related meetings. Newsom says he needs to fast-track the transfer of the shipyard from the Navy to the city if he is to meet the 49ers’ deadline for being in a new stadium by 2012.

The blitz was triggered by the 49ers’ announcement in December 2006 that they were considering a move to Santa Clara – which team officials in part blamed on Newsom’s inattention – leading some Bayview-Hunters Point residents to complain that they’re paying the price for the administration’s fumble. Newsom has proposed folding Candlestick Point and the shipyard into a giant 2,000-acre redevelopment project – to be managed by the Lennar Corp., whose profits are nose-diving and which is being sued for alleged whistle-blower retaliation in connection with its failure to control toxic asbestos dust at the site.

"Newsom’s latest plan confirms his critics’ worst fears that this is a bait and switch," said builder Brian O’Flynn, who was part of last year’s referendum drive to put the city’s previous Bayview-Hunters Point redevelopment plan on the ballot and this year’s lawsuit to force a vote. "This latest plan is about political coverage for the mayor in an election year."

His group, Defend BVHP Committee, was already concerned about Newsom’s role in thwarting a vote on the old plan and has even more concerns about the new plan. "If the 49ers leave and the stadium plan is off the table, then Newsom’s latest proposal will make way for more condos for Lennar," O’Flynn told the Guardian.

Matt Dorsey of the City Attorney’s Office said that regardless of whether the city was right to strike down the referendum – as he maintains state case law required – the new plan will get more scrutiny. The Board of Supervisors voted in February to support Newsom’s approach to the shipyard but stipulated that the terms of any such transfer "require approval by the Recreation and Park Commission, the Board of Supervisors, and such other possible approvals, including voter approval."

The artists’ colony is waiting to learn the specifics of Lennar’s redevelopment proposal, which talks of creating "permanent space for the artists at Hunters Point Shipyard," along with new waterfront parks, 8,500 units of housing, and job-generating development. So far, Michael Cohen of the Mayor’s Office and Lennar’s Kofi Bonner are only shopping around what they call a "conceptual framework," which vaguely describes the parameters for merging the yard and Candlestick Point.

The city has promised to replace all existing low-income housing at the Alice Griffith projects and to phase in new units carefully so as not to displace current residents. The artists have not received such promises. They don’t know if they’ll end up paying double the price for half the space they currently occupy, which amounts to 248,400 square feet, according to building 101 artist David Trachtenberg.

But with Lennar announcing a two-year planning goal and talking about an arts-themed development, the colony is formuutf8g its own ideas about how such a plan could work.

"The shipyard is almost like an artists’ retreat," Estelle Akamine told us, as five colleagues spoke passionately about the light, desolation, and poppies that attract artists to the base.

"But it didn’t always feel like a retreat," recalled Akamine, who has rented at the shipyard for 18 years. "There was a lot of trauma in the 1980s when we thought that the USS Missouri was going to be home-ported here. So we’re very skeptical of plans. We were born out of politics."

The Mayor’s Office claims the city is working to expedite the cleanup and transfer of the shipyard not only to adhere to the 49ers’ timeline but also to "allow us to move forward with community benefits like parks, affordable housing, and jobs for the Bayview." Trachtenberg believes the mayor has a strong interest in keeping artists at the yard too.

Newsom promotes his proposal as a way to create jobs and revitalize the BVHP economy. Akamine said, "Artists are the tip of the iceberg. We’re the visible part of a huge, largely hidden industry." Recalling how artists in SoMa fell victim to the dot-com boom at the end of the ’90s, Akamine hopes such displaced organizations will be able to relocate to the shipyard.

"Why can’t we have galleries and suppliers down here too?" she asked.

April Hankins, who rents a studio in building 117, wants to see "performance space for productions, community theater and music, and touring groups. We are discussing space for classes. Ideally, it could make San Francisco a destination for the arts."

Dimitri Kourouniotis, who rents in building 116, is stoic about the inconvenience he’s already endured, thanks to the Navy’s radiological remediation on Parcel B, where his studio is situated.

"We have already had to leave temporarily," said Kourouniotis, explaining how a three-week project to remove radiological contamination from sewers and pipes ended up taking five months and left six buildings without running water or plumbing.

Hamel, who’s rented a studio in building 101 for 15 years, wants people to know that there’s "nothing wrong" with the artists at the shipyard. "We’re not contaminated, and none of the artists have had problems with illness from possible toxic elements," she says, while Hankins compares artists to the athletes that Newsom is apparently scrambling so hard to keep.

"Both need an arena in which to exhibit increasing skill," Hankins says. "An artist’s work and an athlete’s performance is their gift to their audience. In showing patronage, ball games with high ticket prices are attended; art is collected. In communities and teams, both nourish the culture of the city for which they perform. It would be a great loss to the Bay Area to have the shipyard artist community become a redevelopment casualty." *

Death of fun, the sequel

Fun – in the form of fairs, festivals, bars, art in the parks, and the freedom to occasionally drink alcohol in public places – is under attack in San Francisco.

The multipronged assault is coming primarily from two sources: city agencies with budget shortfalls and NIMBYs who don’t like to hear people partying. The crackdown has only intensified since the Guardian sounded the alarm last year (see “The Death of Fun,” 5/24/06), but the fun seekers are now organizing, finding some allies, and starting to push back.

Mayor Gavin Newsom and other city hall leaders have been meeting with the Outdoor Events Coalition, which formed last year in response to the threat, about valuing the city’s beloved social gatherings and staving off steep fee hikes that have been sought by the Recreation and Park, Fire, Public Works, and Police departments.

Those conversations have already yielded at least a temporary reprieve from a substantial increase in use fees for all the city’s parks. It’s also led to a rollback of the How Weird Street Faire’s particularly outrageous police fees (its $7,700 sum last year jumped to $23,833 this year – despite the event being forced by the city to end two hours earlier – before pressure from the Guardian and city hall forced it back down to $4,734).

The San Francisco Democratic County Central Committee will also wade into the issue April 25 when it considers a resolution warning that “San Francisco has become noticeably less tolerant of nightlife and outdoor events.” It is sponsored by Scott Wiener, Robert Haaland, Michael Goldstein, and David Campos.

The measure expresses this premier political organization’s “strong disagreement with the City agencies and commissions that have undermined San Francisco’s nightlife and tradition of street festivals and encourages efforts to remove obstacles to the permitting of such venues and events up to and including structural reform of government permitting processes to accomplish that goal.”

The resolution specifically cites the restrictions and fee increases that have hit the How Weird Street Faire, the Haight Ashbury Street Fair (where alcohol is banned this year for the first time), and the North Beach Jazz Festival, but it also notes that a wide variety of events “provide major fundraising opportunities for community-serving nonprofits such as HIV/AIDS, breast cancer, and violence-prevention organizations that are dependent upon the revenue generated at these events.”

Yet the wet blanket crowd still seems ascendant. Sup. Michela Alioto-Pier now wants to ban alcohol in all city parks that contain playgrounds, which is most of them. Hole in the Wall has hit unexpected opposition to its relocation (see “Bar Wars,” 4/18/07), while Club Six is being threatened by its neighbors and the Entertainment Commission about noise issues. And one group is trying to kill a band shell made of recycled car hoods that is proposed for temporary summer placement on the Panhandle.

That project, as well as the proposal for drastically increased fees for using public spaces, is expected to be considered May 3 by the Rec and Park Commission, which is likely to be a prime battleground in the ongoing fight over fun.

 

FEE FIGHT

Rec and Park, like many other city departments, is facing a big budget shortfall and neglected facilities overdue for attention. A budget analyst audit last year also recommended that the department create a more coherent system for its 400 different permits and increase fees by 2 percent.

Yet the department responded by proposing to roughly double its special event fees, even though they make up just $560,000 of the $4.5 million that the department collects from all fees. Making things even worse was the proposal to charge events based on a park’s maximum capacity rather than the actual number of attendees.

The proposal caused an uproar when it was introduced last year, as promoters say it would kill many beloved events, so it was tabled. Then an almost identical proposal was quietly introduced this year, drawing the same concerns.

“These are just preliminary numbers, and they may change,” department spokesperson Rose Dennis told us, although she wouldn’t elaborate on why the same unpopular proposal was revived.

Event organizers, who were told last year that they would be consulted on the new fee schedule, were dumbfounded. They say the new policy forces them to come up with a lot of cash if attendance lags or the weather is bad.

Mitigating such a risk means charging admission, corralling corporate sponsorship, or pushing more commerce on attendees. This may not be a hindrance for some of the well-known and sponsored events such as Bay to Breakers and SF Pride, but consider how the low-budget Movie Night in Dolores Park might come up with $6,000 instead of $250, or how additional permit fees could strangle the potential of nascent groups such as Movement for Unconditional Amnesty.

The group is sponsoring a march in honor of the Great American Boycott of 2006. On May 1 it will walk from Dolores Park to the Civic Center in recognition of immigrants’ rights. The group wanted to offer concessions, because food vendors donate a percentage of their sales to the organization, but the permit fee for propane use from the Fire Department was too high.

“They couldn’t guarantee they’d make more than $1,200 in food to cover the costs of permits,” said Forrest Schmidt, of the ANSWER Coalition, who is assisting the organizers. “So they lost an opportunity to raise funds to support their work. It’s more than $1,000 taken off the top of the movement.”

ANSWER faced a similar problem after the antiwar rally in March, when the rule regarding propane permits was reinterpreted so that a base charge, once applied to an entire event, was now charged of each concessionaire – quadrupling the overall cost. ANSWER pleaded its case against this new reading of the law and was granted a one-time reprieve. But Schmidt says none of the SFFD’s paperwork backs up a need to charge so much money.

“They kept on saying over and over again, ‘You guys are making money on this,’ ” Schmidt said. “But it’s an administrative fee to make sure we’re not setting anything on fire. It’s essentially a tax. It’s a deceitful form of politics and part of what’s changing the demographic of the city.”

The Outdoor Events Coalition, which represents more than 25 events in the city, agrees and has been meeting with city officials to hash out another interim solution for this year, as well as a long-term plan for financial sustainability for all parties.

“We’re cautiously optimistic,” said Robbie Kowal, a coalition leader and organizer of the North Beach Jazz Festival. But he’s still concerned about what he and the coalition see as a continuing trend.

“The city is changing in some way. It’s becoming a culture of complaint. There’s this whole idea you can elect yourself into a neighborhood organization, you can invent your own constituency, and the bureaucracy has to take you seriously. Neighborhood power can be so effective in fighting against a Starbucks, but when it’s turned around and used to kill an indigenous part of that neighborhood, like its local street fair, that’s an abuse of that neighborhood power.”

 

NIMBY POWER

Black Rock Arts Foundation, the San Francisco public art nonprofit that grew out of Burning Man, has enjoyed a successful and symbiotic partnership with the Newsom administration, placing well-received temporary artwork in Hayes Green, Civic Center Plaza, and the Embarcadero.

So when BRAF, the Neighborhood Parks Council, the city’s Department of the Environment, and several community groups decided several months ago to collaborate on a trio of new temporary art pieces, most people involved thought they were headed for another kumbaya moment. Then one of the projects hit a small but vocal pocket of resistance.

A group of artists from the Finch Mob and Rebar collectives are now at work on the Panhandle band shell, a performance space for nonamplified acoustic music and other performances that is made from the hoods of 75 midsize sedans. The idea is to promote the recycling and reuse of materials while creating a community gathering spot for arts appreciation.

Most neighborhood groups in the area like the project, and 147 individuals have written letters of support, versus the 17 letters that have taken issue with the project’s potential to draw crowds and create noise, litter, graffiti, congestion, and a hangout for homeless people.

But the opposition has been amplified by members of the Panhandle Residents Organization Stanyan Fulton (PROSF), which runs one of the most active listservs in the city, championing causes ranging from government sunshine to neighborhood concerns. The group, with support from Sup. Ross Mirkarimi’s staff, has delayed the project’s approval and thus placed its future in jeopardy (installation was scheduled to begin next month).

“My main concern would be that this is a very narrow strip of land that is bordered by homes on both sides,” said neighbor Maureen Murphy, who has complained about the project to the city and online through the PROSF. “My fear is that there is going to be amplification and more people and litter.”

The debate was scheduled to be heard by the Rec and Park Commission on April 19 but was postponed to May 3 because of the controversy. Nonetheless, Newsom showed up at the last hearing to offer his support.

“Rare do I come in front of committee, but I wanted to underscore … the partnership we’ve had with Black Rock Arts Foundation. It’s been a very successful one and one I want to encourage this commission to reinforce,” Newsom told the commission. “I think the opportunity exists for us … to take advantage of these partnerships and really bring to the forefront in people’s minds more temporary public art.”

Rachel Weidinger, who is handling the project for BRAF, said the organizers have been very sensitive to public input, neighborhood concerns, environmental issues, and the impacts of the project, at one point changing sites to one with better drainage. And she’s been actively telling opponents that the project won’t allow amplified music or large gatherings (those of 25 or more will require a special permit). But she said that there’s little they can do about those who simply don’t want people to gather in the park.

“We are trying to activate park space with temporary artwork,” she said. “Guilty as charged.”

Yet any activated public space – whether a street closed for a fair or a march, a park turned into a concert space, or a vacant storefront turned into a nightclub – is bound to generate a few critics. The question for San Francisco now is how to balance NIMBY desires and bureaucratic needs with a broader concern for facilitating fun in the big city.

“Some people have the idea that events and nightlife are an evil to be restricted,” Wiener said. But his resolution is intended as “a cultural statement about what kind of city we want to live in.” *

Also featuring performances by Freq Nasty, Bassnectar, Vau de Vire Society, El Circo, and other DJs and artists from San Francisco and elsewhere, LIB attempts to change the precedent that festival fun has to be ecologically disastrous.

And peace is what this festival, which promotes "conscious" music, is all about. Plus, a range of representatives of environmental and social issues will be tabling at the festival — and registering voters.

BEYOND

"Burning Man" Black Rock City, Nev.; (415) TO-FLAME, www.burningman.com. Aug 27-Sept 3, $250-$280. With its Leave No Trace philosophy and its hippie roots, Burning Man has always been greener than most. But this year it’s getting even more explicitly so with the theme the Green Man, focusing on humanity’s relationship to nature (even though there is no nature on the dry lakebed surface). A pessimist might suggest this year’s theme is just another excuse to waste resources on leaf-themed art cars and that "Leave No Trace" usually translates to "Leave Your Trash in Reno." But an optimist might say this is Burning Man acknowledging and trying to address such issues. Either way, air out your dust-filled tent and pack some chartreuse body paint — it’s going to be an interesting year in Black Rock. *

Open water

For the casual stroller, a walk under the 101 interchange at César Chávez is none too inviting. Trucks and cars zoom off the freeway and onto the street all day long, bringing noise and exhaust with them. An atmosphere of abandonment and neglect allows crime to fester.

And if you dare to walk far enough under the highway, you might notice that water often floods the lowest point of the underpass.

That’s not rain collecting; it’s water seeping into the streets from the paved-over Islais Creek, which runs through Glen Park to the eastern neighborhoods and ultimately channels into the bay.

It’s just one of a network of creeks that flow through San Francisco, invisible urban treasures that have long since been filled in or paved over. The city has been burying the creeks since the 1906 earthquake. Back then the Board of Supervisors voted to fill the marshy lands near Islais with debris from the fires.

Standing under the overpass, Bonnie Ora Sherk, artist and founder of the urban planning nonprofit Life Frames, reaches for some leaves poking through a chain-link fence that separates the path from mostly empty islands of space. I can barely hear her through the ongoing traffic din when she says, "I haven’t been here in so long…. See those roses? We planted those."

Sherk dreams of allowing some of the water in the area to emerge from its underground culvert and fill a pond surrounded by beautiful riparian plantings such as willow trees.

With the Planning Department putting the finishing touches on its eastern neighborhoods plan and the Mayor’s Office launching its Better Streets program — which will put $20 million toward improving streets, sidewalks, and unused spaces — it’s a good time to talk about daylighting Islais Creek.

Sherk wants only a small piece of the underground stream brought back to life, but in theory San Francisco could open up much bigger stretches, allowing water to flow through neighborhoods and parks between its source in Glen Canyon Park and its outflow.

Sherk has been turning forsaken lots and concrete jungles into thriving natural areas that provide educational opportunities for children since she started the Crossroads Community art collective, also known as the Farm, under the freeway in 1974. With a colony of artists, she turned the void into a crossroad for the Bayview, Bernal Heights, and Mission District communities. During her six years at the collective, she led children from the neighborhoods in planting and gardening, built a barn for chickens and goats, and curated art shows.

Check out the photos on a Living Library Web site (www.alivinglibrary.org), and you’ll see how that area flourished during Sherk’s days as the collective’s executive director. Back then a landscape of native plants grew under the overpass. Now fences enclose these scraps of dead space to keep homeless people from setting up encampments in them.

When Sherk learned from old maps that the area was built over a watershed of intersecting creeks that feed into Islais, she tried to convince the city to uncover some of the creek water that flows under an open space next to the Farm, what is now Potrero del Sol Park.

The city built the park as she suggested but separated it from the artist community by a fence. Her idea to expose the creek wasn’t adapted either. A concrete-bottom pond fed by Hetch Hetchy water was installed instead. Soon it will be transformed into a skateboarding area, which Sherk thinks is better than constantly piping in precious reservoir water.

But she hasn’t given up on the idea of daylighting Islais at the interchange. She envisions diverting the off-ramps a bit to make way for the pond at the center of the underpass. From there César Chávez would be resculpted into a curving road, forcing traffic to slow down. Poplars could line the street, and educational artwork could be added to the mix. The fences would come down under the freeway, and the area once again would be replanted. It would be a nice place to drive and walk. Perhaps the crime and litter would disappear.

According to Sherk, the idea of an urban environment needs a paradigm shift from the days of factory-school settings. To her, it’s not just a matter of beautification or convenience. "Why do one thing when you can do 10 things simultaneously?" she asks — meaning a pond isn’t just a pool of water, it’s part of a place where nature intersects with industry, technology, and our everyday culture and where we can look at all of those elements, as she often says, "through the lens of time." *

UC Extension project a bad deal

EDITORIAL Something has to be done with the old University of California Extension site, a 5.8-acre parcel of largely unused land at Laguna and Market. The historic buildings are locked and sitting empty; there’s no public access to the site at all. That’s a huge amount of land to be essentially going to waste in a crowded neighborhood that lacks parks and open space.

But there are competing issues here: the university, which doesn’t want the land anymore, wants to get every penny it can out of the property. And that’s led the university to enter into a long-term agreement with A.S. Evans, a big private developer, to turn the site into a mixed-use project with nearly half a million square feet of mostly market-rate housing, some retail, some community-use and open space, and a lot of parking. Among the plums Evans is holding out: the project is slated to include 85 units of senior housing targeted to the LGBT community. The Planning Department points out in an environmental impact report that the public will be able to access a modest park in the project center, where Waller Street, which now dead-ends at the site, will be opened up.

But this land is and has been zoned for public use and used by public institutions for a century or more. It represents almost 20 percent of all the public space in the Octavia-Market neighborhood. And if it’s going to be turned over to a private developer, the public needs to get a lot more out of the deal than this project offers.

For starters, like so much else that city planners are pushing these days, this is going to be housing for rich people — mostly single or childless rich people. Of the 365 units that aren’t included in the LGBT housing, 304 would be studio and one-bedroom units. And the 15 percent set aside as affordable housing still means only 54 units would be sold or rented below market rate. Only a tiny handful of the new units would be any help at all to the endangered population of working-class families — the ones who are fleeing the city in droves, the ones whom the Mayor’s Office claims to be concerned about.

At the 15 percent affordability level, exactly 13 out of the 85 units of LGBT housing would be available to anyone who isn’t wealthy. So 13 very lucky queer seniors or couples, out of the entire needy population in San Francisco, would win a lottery and get a decent place to live at a price they can pay.

And for that, San Francisco would give up 5.8 acres of public space and allow the demolition of some historic structures. It doesn’t seem like such a great deal.

Yes, there will be a community center and some other amenities, but overall this a private developer’s plan to make a lot of money selling expensive condos — which are the last thing San Francisco needs right now.

Rejecting this particular deal doesn’t mean the city is giving up on a better use for the site. If the school is told clearly that the only way San Francisco will rezone this land for private use is if the new project meets (or at least makes a real effort to meet) the goals in the city’s General Plan, which require that two-thirds of all new housing be affordable, the university will have to reconsider its financial demands on the project. And if it doesn’t, that’s something San Francisco’s state legislators should take up with the chancellor and the regents. *

For decades the narrow strip of land at the corner of Fulton and Stanyan streets in the Inner Richmond sat abandoned, accumuutf8g weeds and trash. At some point in the distant past, neighbors say, it had been a nice lawn, but no one remembers exactly when that was.

"I walk past it every morning," 75-year-old Kathleen Russell, who has lived in an apartment overlooking the lot for 34 years, told the Guardian. "I kept hoping somebody would put a lawn in or something, something that was pretty. But it was just left vacant and unattended."

Last year the Department of Public Works posted a sign declaring the vacant land blighted after receiving repeated complaints. Then in January a small group of neighbors began transforming the lot into a community garden. They cleaned up the garbage, cut down the weeds, and planted vegetables. Soon after, the DPW sign disappeared and was replaced by fava beans, garlic, and lettuce.

Justin Valone, who lives down the street from the piece of land, helped initiate the garden. "The response from the community has been amazing," he told us enthusiastically. "We’ve had nothing but support from neighbors. It’s been a real catalyst for getting to know everyone in the neighborhood."

Only one person seems to take issue with the project: the landowner. While visiting San Francisco from her out-of-town home, Aileen O’Driscoll discovered the guerrilla garden on her property and was less than thrilled. She also found neighbors using a hose from her building to water the plot without permission. O’Driscoll told Citywide Property Management, which takes care of the lot and the adjacent apartment building, that she wanted them off her land. She refused to speak to the gardeners directly and did not respond to our inquiries.

Carol Cosgrove, co-owner of Citywide, has been responsible for returning the lot to its unkempt state. "I think beautification of the city is important. I agree with it completely, but I think that personal property and private property is still important," she told us. "Instead of taking something aggressively and taking the water and not even bothering to seek out who the owner is and ask permission or to give a proposal to, this could have been done more responsibly."

Citywide got in touch with Valone and told him to stop using its water (which he did) and to remove the plants (which he didn’t). In response, gardeners began trying to generate broader support for the garden. They went door-to-door with a petition. Some neighbors asked Citywide to leave the plants alone.

Still O’Driscoll refused to talk. The San Francisco Parks Trust contacted the property managers to show there is organizational support for the garden. District Supervisor Jake McGoldrick’s office called too, offering to help mediate a deal between the two groups. The gardeners even agreed to lease the unused land. Citywide says it has presented the case to the owner many times, but O’Driscoll won’t budge and won’t offer an explanation.

"I can’t really speak for her, but she doesn’t want the garden there right now," Cosgrove said.

Gardeners are frustrated by her unwillingness to talk to them. "We could address her specific concerns, but without knowing what they are, we can’t do anything," says Becky Sutton, another garden organizer.

When they felt negotiations were going nowhere, garden supporters began holding a constant vigil at the lot, hoping for the chance to speak to the landowner directly. Groups of friends and neighbors stayed by the garden for days, talking to passersby and getting more signatures on the petition. Currently they have more than 300.

The benefits of the garden would extend beyond the 1,300-square-foot plot, advocates assert. "Green space in San Francisco is very valuable to all residents," said Jude Koski, director of the San Francisco Garden Resource Organization (SFGRO), a local community gardening organization that is willing to help broker a deal over the land. "It is a wonderful way to engage the community. It’s an opportunity for people to come together who wouldn’t otherwise be coming together." According to a 2004 survey by the Recreation and Park Department, 47 percent of San Franciscans would like to see more community gardens in the city.

The two sides have reached something of an impasse: O’Driscoll wants the garden gone, Citywide says it has no choice but to follow her orders, and the gardeners don’t want the lot to go back to dirt and weeds.

But even if they lose this lot, the gardeners see the fight as ongoing. "We want to see this garden not just be bound by the concrete that is all around it but be something that will inspire people and help them know they can utilize vacant land in their neighborhoods," Valone said. "People can take responsibility for beautifying and creating important and useful resources for themselves and their neighbors in the space around them. Whether you’re a renter, whether you own land or not, you can still take responsibility for land and utilize it." *

Leno and Ma Scrutinize Alcatraz

Did poo get washed into the bay or not? Mark Leno and Fiona Ma really want to know. They’ve written another letter to the National Park Service’s Superintendent, Brian O’Neill, calling for an independent investigation, and essentially telling him his excuses and explanations hold no water.

Back in January, the two California State assembly members asked O’Neill to look into allegations that a sewage holding tank on Alcatraz Island overflowed and was hosed into the bay rather than wiped up properly.

O’Neill wrote back that an internal investigation had been done and all claims were false — except according to our elected officials, his evidence doesn’t support his claims. In addition, one of the whistleblowers who saw the spill, a National Parks Conservancy employer named Dan Cooke, has been fired, apparently for speaking up.

San Francisco dogs have it made, don’t they? Their owners coddle them with gourmet food from boutique pet stores, groomers who treat them like royalty, and the biggest spoiler of them all, our many acres of parks and beaches. But this sweet deal is not without its price. In the case of the last indulgence, this means the dirt pits, mud puddles, and pee-soaked grass your little stinker can’t resist rolling in. Bathing your dog at home can be quite a production, especially if you live in tight quarters. Fortunately, the city has a nice selection of places where you can scrub your mucky pup for a small fee, leaving you and your buddy with the soothing knowledge that you won’t have a bathtub to clean or a floor to mop afterward.

Nine years after setting up shop in Bernal Heights, owner Tony Chrisanthis has built Bernal Beast (509 Cortland, SF. 415-643-7800, www.bernalbeast.com) into a bit of a local legend. Packed wall to wall with supplies, food, and some hard-to-find supplements, this is a destination for pet lovers from around the Bay. At the back of the shop is the rather roomy washing station, where for $12 you get all-natural shampoo and conditioner, towels, driers, grooming tools, and an apron.

Conveniently located only a few blocks from the beach, Bill’s Doggie Bath-O-Mat (3928 Irving, SF. 415-661-6950) is a hit with folks taking their pup for a swim. The clean and fuss-free shop is equipped with three wash stations, available for self-service from Tuesday to Saturday. For $14 (and $10 for each additional dog) you will get all the necessary accoutrement needed to wash away the sea.

For dog lovers down in Glen Park, Critter Fritters (670 Chenery, SF. 415-239-7387) offers two dog-washing stations and two grooming tables in the spacious back room. The cost of the service is $13 — negotiable if washing multiple dogs — and includes all-natural shampoos, towels, chamois cloth, driers, grooming tools, and an apron. Tubs are equipped with "power wash" nozzles, which give quite effective, dirt-loosening blasts of water, guaranteeing a deep clean for your grubby pet.

For a bit of small-town charm here in the big city, try the Pawtrero Hill BathHouse and Feed Co. (199 Mississippi, SF. 415-882-7297, www.pawtrero.com). Designed with an old-fashioned seed store theme, using wooden produce crates to display its many tempting organic and natural wares, the shop offers a homey wash-up for your dog. The bathhouse at the back of the store is equipped with two raised tubs buttressed by ramps. For $15 you get everything you’ll need to make your mutt squeaky-clean: all-natural shampoo, towels, driers, brushes and clippers, and an apron to keep yourself dry. Mercifully, the newest dog-washing addition to the city, Puppy Haven (772 Stanyan, SF. 415-751-7387), set up shop on Haight Street, where even humans need a postpromenade bath. Founded by longtime neighborhood resident Gordon Ruark — a font of knowledge with 25 years of pet store experience — the shop offers a spacious wash room equipped with two cleaning stations and will soon have a grooming station. For $10, Ruark gives you everything you need: shampoo, towels, forced-air driers, and a peaceful respite from the sometimes frantic energy lurking outside.

Cheerfully adorned with warm, playful colors and scores of houseplants, the Soggy Doggy Bath and Barktique (4033 Judah, SF. 415-664-3644), another oceanside option, is a relaxing place to take your pooch after a romp on the beach. There is one wash station with an elevated tub and a separate grooming table. For $13 you can hose away the sand with all-natural shampoo and conditioner, after-bath spritz, towels, and grooming tools. Get your ninth self-serve wash free with a "Repeat Rover Miles" card. Hours for self-serve are 3 to 7 p.m., Wednesday to Friday, and 10:30 a.m. to 6 p.m. on weekends, but call ahead anyway.

Pawtrero’s sister store, the South Paw BathHouse and Feed Co. (199 Brannan, SF. 415-882-7297, www.pawtrero.com), offers similar services and the same holistic philosophy but with a South Beach flavor, as indicated by the pastel furniture and "Beach Access" sign above the entrance to the washing quarters. Fifteen dollars gets you the same provisions as those supplied by Pawtrero, and the same discount program applies.

With a steady business of full-service dog grooming, Wags: Pet Wash and Boutique (1840 Polk, SF. 415-409-2472, www.sfwags.com) limits self-service to Sundays, but try calling ahead Tuesday to Thursday. Decked out in brightly colored shower curtains, the washing area is set up with two tubs and one combination tub-grooming station. Whistle blower axed

Dan Cooke, an educator and historical interpreter who guided tours of Alcatraz Island for the Golden Gate National Parks Conservancy, has been fired in the wake of a Guardian article that quoted him complaining about a sewage spill in the Bay.

On March 3, 2007 Cooke was informed by his supervisor, John Moran, that his position had been terminated because there weren’t enough hours available to keep him employed.
However, the day before Cooke was fired, and for several days after, the GGNPC website was advertising an immediate opening for the same position as Cooke’s. That posting has since been removed from the web site.
Cooke has filed an administrative complaint with the United States Department of Labor against GGNPC and NPS, claiming he should be protected under the whistleblower provisions of several federal environmental and health safety acts.

Cooke was a source for an article about possible sewage spills on the island (see “Smelly Situation,” Dec. 27, 2006) and told the Guardian that on Oct. 13 he witnessed Alcatraz Cruises boat crew hosing raw sewage into the bay from an overflowing holding tank on the island. The spill was also witnessed by the captain of a passing ferry boat, who reported what he saw to California’s Environmental Protection Agency.

National Park Service spokespeople dismissed those claims in interviews with us for the article and said it was their understanding the spill in question was just salt water.
Cooke was a part-time, “on-call” employee and his hours often fluctuated with the seasons. In December, he took two months off to visit his family in England, but since his return in late January he had not been scheduled for any shifts.

He contacted his supervisor, Moran, to find out why. According to the administrative complaint filed by Cooke’s lawyer, Eleanor Morton, “Moran told Cooke that Cooke’s statements in the San Francisco Bay Guardian article had ‘caused a big flap’ at GGNPC and NPS. Moran said that there had been multiple meetings about the article. Moran said that there was a high level of anger and resentment at GGNPC toward Cooke for his statements, that NPS was very concerned and that Moran himself had felt pressured to say that he also was angry at Cooke.”

Cooke says he noted the spill in the NPS logbook because that was protocol, and spoke to the Guardian because he was concerned about public health and safety. “My training is if you see things that concern you, write them down and inform your supervisor,” he said.

When contacted by the Guardian, NPS spokesperson Chris Powell said, “the National Park Service has no comment at this time. We just can’t talk about things like this.”

GGNPC also refused to comment on personnel issues.

Cooke remains concerned about conditions of the sewage system on the island and whether or not what he and others witnessed on October 13 has been properly investigated. “I’ve never been asked a question about this once by anyone at the National Park Service. Nobody’s ever asked me what happened,” he said. He said that the park’s superintendent, Brian O’Neill. “needs to say when these events occur we will do a proper investigation.”
Assemblymembers Mark Leno and Fiona Ma agree. After reading the Guardian article, as well as receiving additional evidence of possible E. coli-riddled bilge water from a boat in the Alcatraz fleet, Leno and Ma called on the NPS and San Francisco Bay Regional Water Quality Control Board to investigate the island and ferry service sewage issues.

In a joint letter drafted Jan. 17, they wrote: “The Alcatraz Ferry Service is one of San Francisco’s major tourist destinations with international visibility and the volume of these trips is significant. For these reasons, we would like to know if the problems …have been thoroughly or should be thoroughly investigated by your agency with assistance from the appropriate federal or local officials.”

Superintendent O’Neill responded that “the investigations were closed as ‘unjustified complaints’” and questioned the origin and verity of the E.Coli test sample, which obtained by Marina Secchitano, regional director of the Inland Boatmen’s Union, who has been protesting Alcatraz Cruises ferry contract with the NPS (See “Casting off,” Sep. 26, 2006).

O’Neill questioned Secchitano’s ability to gain access to the bilge of the boat from where it’s claimed the sample hailed, and also said the results were from a lab where “this was not the kind of testing that they do.” But in fact, someone with access to the bilge gave the sample to Secchitano – and the lab in question, Brelje and Race, confirmed that this is, in fact, exactly the kind of testing they do.

“We received a copy of your letter discrediting our laboratory results,” wrote Ann Hill to the NPS. “Although we can’t vouch for where this sample was collected from, we do stand by our results….We did not tell Alcatraz Cruises that this was not the type of testing we do. I talked with them and told them we did not collect or pick up samples that far away.” Which wasn’t an issue in this case, since a spokesperson for the union told us Secchitano brought the sample to the lab.

As far as what Cooke and an anonymous captain witnessed, O’Neill continued to maintain it was just sea water. “This complaint is erroneous and unjustified; allow us to clarify what happened,” he wrote, submitting as evidence a written statement from the island’s facilities engineer, James L. Adams — except the incident Adams cites, of a parted salt water line, was four days after the overflowing shit tank that Cooke and the captain saw.

“The letter kind of skirted the question,” said Ma spokesperson, Nick Hardeman, summing up O’Neill’s response. “The Brian O’Neill letter to Fiona and Mark is all the more reason there needs to be an independent investigation. There are disputing facts here. We need to find out what’s going on.” Hardeman has met with Cooke and is in discussion with Rep. Nancy Pelosi’s office to determine the proper jurisdiction for a full and independent investigation of the sewage system on Alcatraz and handling of it by Alcatraz Cruises.

Cooke says that’s the only reason he ever noted the spill in the first place. “I want an investigation. I want to go back to work. And I’d like the toilets to get fixed on the island. It’s a basic right for workers and visitors to the park,” he said. “If the net result is the termination of a person related to the leaking of the information, if that’s the only follow-up instead of an investigation, that’s a problem.” At this point, he is considering further legal action but is demanding only that the job he loves be reinstated and the appropriate back pay granted.

“The firing of Dan Cooke clearly raises a red flag,” Ma said in a statement to the Guardian. “My hope is that the National Park Service is committed to the protection of the fragile ecosystem of the Bay. If even some of Mr. Cooke’s allegations are true, it’s clear that NPS mistakenly thinks their reputation matters more than our environment.”

What’s the matter with the De Young?

All around the world, popular museums are situated in public parks with wonderful results for both the museums and the parks.

But here in San Francisco, the venerable de Young Museum is waging an intense and irrational battle to prevent more San Francisco families and visitors from enjoying Golden Gate Park — even at the expense of its own reputation and financial well-being. Our organizations are baffled.

The museum’s leadership is doggedly fighting a community proposal called Healthy Saturdays, which would extend the popular Sunday recreational space in the park to Saturdays on a six-month trial basis.

Why would the de Young fight this when its own figures show that museum attendance increases on car-free Sundays in the park?

Why, when a recent city study (available at www.goldengatepark.org) shows that car-free space does not significantly affect parking availability or traffic in the neighborhoods and doubles park usage, boosts local business, and helps drive traffic to (and pay off the debt for) the de Young’s unfilled 800-car garage?

Why, last spring, did the de Young spend thousands to send misleading letters to its members, falsely claiming that Healthy Saturdays would "severely compromise" access to the museum? Dozens of disgruntled de Young members pointed out the letter did not mention that the garage is accessible from outside the park and that visitors have front-door, drop-off access every day.

All of the high jinks and mistruths are especially baffling given the de Young’s past endorsement of the concept. In 2000 the museum supported and funded Proposition G, which called for car-free Saturdays just after the garage was opened. According to their ballot argument, de Young leaders believed the Saturday proposal "ensures access to the de Young Museum for all San Franciscans including families with children, seniors and the disabled; [and] ensures the maximum enjoyment and minimum inconvenience to park users."

At times the de Young has claimed that it is fighting out of concern for disabled access, but the tactics of the museum folks suggest otherwise. Why did they not actively support Supervisor Jake McGoldrick’s legislation, which passed unanimously last year, to add more accessible parking, drop-off zones, and a free accessible tram in the park on Sundays?

And why are museum leaders suggesting that the car-free space be moved out to the west end of the park, far from transit, the parking garage, and local businesses?

Finally, if the de Young were working in good faith to improve its own attendance and revenue (and we all want a successful de Young Museum), why would this partially public-funded museum deny city officials’ requests to make its attendance figures public, relenting only after a Guardian reporter filed a Sunshine Ordinance request? The figures, when they were begrudgingly shared last year, showed a boost in de Young attendance on car-free days — which of course brings us back to our original question:

Why is the de Young fighting so intensely against its own interests and those of Golden Gate Park visitors? *

The corporation that ate San Francisco

For the past decade, Florida-based megadeveloper Lennar Corp. has been snatching up the rights to the Bay Area’s former naval bases, those vast stretches of land that once housed the Pacific Fleet but are now home to rats, weeds, and in some places, low-income renters.

When the Navy pulled out of Hunters Point Shipyard in 1974, it left behind a landscape pitted with abandoned barracks, cracked runways, spooky radiation laboratories, antique cranes, rusting docks, and countless toxic spills.

A quarter century later, Lennar came knocking at the shipyard’s door — and those of other military bases abandoned in the waning days of the cold war — recognizing these toxic wastelands as the last frontier of underdeveloped land in urban American and an unparalleled opportunity to make big money.

Lennar had already won its first battle in 1997, seizing control of the Bay Area’s former military pearl in Vallejo when it was named master developer for the old Mare Island Naval Shipyard. Two years later it almost lost its bid for Hunters Point Shipyard when a consultant for the San Francisco Redevelopment Agency recommended giving the development rights to the Ohio-based Forest City.

Lennar fought back, calling on politically connected friends and citing its deep pockets and its track record at Mare Island.

A parade of Lennar supporters, many of them friends of then-mayor Willie Brown and Rep. Nancy Pelosi, told the Redevelopment Agency commissioners that Lennar was the only developer that had bothered to reach out to the Bayview–Hunters Point community. In the end, the commissioners — all of them mayoral appointees — ignored their consultant’s advice and voted for Lennar.

Nobody knows if Forest City would have done a better job. A developer is, after all, a developer. But Lennar’s victory at the shipyard helped it win the rights, four years later, to redevelop Treasure Island — long before it had even broken ground at Hunters Point. And a couple years ago, it parlayed those footholds into an exclusive development agreement for Candlestick Point.

Now the Fortune 500 company, which had revenues of $16.3 billion in 2006, does have a track record at the shipyard. And that performance is raising doubts about whether San Francisco should have entrusted almost its entire undeveloped coastline to a profit-driven corporation that is proving difficult to regulate or hold accountable for its actions.

Sure, Lennar has provided job training for southeast San Francisco residents, set up small-business assistance and community builder programs, and invested $75 million in the first phase of development. That’s the good news.

But on Lennar’s watch, a subcontractor failed to monitor and control dangerous asbestos dust next to a school at the Hunters Point Shipyard, potentially exposing students to a deadly toxin — despite promising to carefully monitor the air and control the construction dust.

And when the homebuilding industry took a nosedive last year, Lennar reneged on its promise to provide needed rental housing on Hunters Point — saying that its profit margins were no longer good enough to make rentals worthwhile. All of which raises questions about whether this company, which is working with Mayor Gavin Newsom to build a stadium at the shipyard to keep the 49ers in town, really has San Francisco’s interests in mind.

Bayview–Hunters Point native Dr. Ahimsa Porter Sumchai, a physician and a Sierra Club member, called the Lennar deal the "dirty transfer of the shipyard." She told us, "There is no reason why I’d trust Lennar more than I would the Navy and the federal regulators who have stringently worked on the cleanup of Hunters Point Shipyard, and yet it still remains toxic."

"This is just a play to get the shipyard," said Porter Sumchai, whose father was a longshore worker at the shipyard and died from asbestosis.

Part of the problem is systemic: the Redevelopment Agency hands over these giant projects to master, for-profit developers — who can then change the plans based on financial considerations, not community needs. And while Lennar likes to tell decision makers of its massive size and resources, the actual work at these bases has been delegated to limited-liability subsidiaries with far fewer available assets.

In this case, Lennar experienced a 3 percent drop in sales last year, a 29 percent increase in cancellation rates on homes, and a 15 percent dip in its fourth quarter profits. The downturn prompted Lennar’s president and CEO, Stuart Miller, to identify ways to improve what he described in the annual report as the company’s "margin of improvement" in 2007. These included "reducing construction costs by negotiating lower prices, redesigning products to meet today’s market demand and building on land at current market prices."

A Lennar spokesperson, Sam Singer, issued a statement to us saying that "Lennar BVHP is committed to operating responsibly, continually incorporating best community and environmental practices into our everyday business decisions."

But for a look at how Lennar’s model clashes with community interests, you need go no further than the edge of the site where Lennar has been digging up asbestos-laden rock.

DUST IN THE WIND


The Muhammed University of Islam is a small private school that occupies a modest flat-roofed hilltop building on Kiska Road with a bird’s-eye view of the abandoned Hunters Point Shipyard. This year-round K–12 school is affiliated with the Nation of Islam and attracts mostly African American students but also brings in Latino, Asian, and Pacific Islander children, many of whom have had problems in the public school system and whose parents can’t cover the cost of a private school.

"We find a way," the school’s mustachioed and nattily dressed minister, Christopher Muhammed, recently told the Redevelopment Agency in a veiled allusion to the financial nexus between the MUI and the Nation of Islam’s mosque and bakery on Third Street. "Many students aren’t members of our tradition but live across the street, down the street, or come from Oakland and Vallejo."

The minister is asking the Redevelopment Agency, the agency that selected Lennar and oversees the project, to permanently relocate the school. The school’s classrooms and basketball courts sit on the other side of a chain-link fence from Parcel A, which is the first and only plot of land that the Navy has certified at the shipyard as clean and ready for development.

Standing on these courts, the children have been able to watch heavy machinery digging up and moving huge amounts of earth in preparation for the 1,600 condos and town houses that Lennar wants to build on this sunny hillside, which has views of the bay and the rest of the shipyard.

The shipyard’s other five parcels are still part of a federal Superfund site, despite having undergone years of decontamination. Black tarps cover piles of soil that have been tagged as contaminated, and recently, radiological deposits were found in the sewers and soil. The Navy is still cleaning up a long list of nasty toxins, including PCBs and solvents, on Parcels B through F, the land Newsom now wants the city to take over so that it can hastily build a stadium for the 49ers.

But the minister’s request to relocate the MUI isn’t inspired by fear of Navy-related contamination or the impact of a stadium on the neighborhood but rather by the reality that asbestos is naturally present in this hillside and Lennar’s excavation work on the other side of the school’s chain-link fence has been kicking up dust for almost a year.

It’s not that Lennar and the city didn’t know about the asbestos. In April 2000 the environmental impact report for the shipyard reuse noted, "Because asbestos-containing serpentinite rock occurs at Hunters Point Shipyard, construction-related excavation activities could cause chrysotile asbestos associated with serpentinite to become airborne, creating a potentially significant impact to public health and safety."

So when Lennar proposed demolishing abandoned housing and roads and grading and transferring massive amounts of earth on Parcel A, the Bay Area Air Quality Management District demanded an asbestos dust mitigation plan that included sweeping and watering the construction sites and making sure that vehicle tires are washed before drivers exit.

The state Asbestos Air Control Toxic Measure also stipulates that if a school lies within a quarter mile of a construction site, local air districts can require developers to install asbestos dust monitors and shut down their sites whenever asbestos registers 16,000 fibers per cubic meter. The state requires these extra steps because children have higher metabolisms, growing lungs, and longer life expectancy. Plus, they’re lower to the ground and are likely to run, skip, hop, and play ball games that kick up dust.

Although Lennar agreed to abide by the air district’s requirements, the developer failed to properly implement this plan for more than a year.

The air district’s records show that Lennar’s environmental consultant, CH2M Hill, failed to include any air monitoring in its original plan for Parcel A, which is odd because the school is obvious to anyone who visits the site. It was only when the air district pointed out the existence of the Hunters Point Boys and Girls Club, the Milton Meyer Recreation Center, and the MUI, all within the quarter-mile limit, that Lennar agreed, at least on paper, to what the air district describes as "one of the most stringent asbestos dust mitigation plans in the state."

The plan combines the air district’s asbestos requirements with the city’s demands that Lennar limit "ordinary dust" that can cause respiratory irritation and aggravate existing respiratory conditions, such as asthma and bronchitis. Lennar agreed to implement the plan in the summer of 2005 and determine background levels of dust and toxins at the site before work began in the spring of 2006.

But that didn’t happen. For 13 months there is no data to show how much asbestos the MUI students were exposed to, neither for the 10 months before construction started on the cleared site nor for the first three hot and dusty months when Lennar’s subcontractors began massive earth-moving operations next to the school.

You’d think that after these failures became public knowledge, a devastated Lennar would have gotten a black eye and perhaps fired the subcontractors involved. Failing to protect children in a community that’s been the repeat victim of environmental injustice is a public relations nightmare, particularly in a part of town where distrust of redevelopment runs deep, thanks to the travesties in the Fillmore in the 1960s, followed by the city’s recent rejection of a referendum to put the Bayview–Hunters Point Redevelopment Plan to a public vote.

But while Lennar’s executives finally did the right thing last August by alerting the air district and replacing CH2M Hill, they didn’t release their two other subcontractors, Gordon Ball and Luster, nor did they sufficiently rein them in when violations continued, critics have testified at agency meetings.

And instead of apologizing to the air district and the city’s Department of Public Health for making them look like impotent fools, Lennar executives pushed back, contending that asbestos monitoring wasn’t necessary until May 2006 and that they didn’t need to water the tires of private vehicles.

They even listed economic rationalizations for the screwups that did happen. According to a memo marked "confidential" that the Guardian unearthed in the air district’s files, written by the air district’s inspector, Wayne Lee, Lennar stated, "It costs approximately $40,000 a day to stop grading and construction activity" and "Gordon Ball would have to idle about 26 employees on site, and employees tend to look for other work when the work is not consistent."

Meanwhile, the Department of Public Health was left reeling. Environmental health director Dr. Rajiv Bhatia told us, "It was very disappointing. We worked very hard. We wanted this system to be health protective. Whenever things don’t work, it takes time to get back to levels of trust. This hurts trust and credibility."

In September 2006 the air district issued Lennar a notice of violation for the period of July 14, 2005, through Aug. 3, 2006. Lee wrote that vegetation removal on the site "disturbed the soil and in some cases, likely resulted in dust." He also made it clear that "any track onto common roads could be tracked out to public thoroughfares and create asbestos dust plumes."

Lennar’s fines have yet to be determined, but they could reach into millions of dollars. State fines for emitting air contaminants range from $1,000 a day, if the violation wasn’t the result of intentional or negligent conduct, to $75,000 a day, if the conduct was deemed willful and intentional.

But as the air district weighs the evidence, one thing’s for sure: this wasn’t an isolated case of one set of monitors failing or one subcontractor screwing up. This case involves numerous violations and three subcontractors, two of which — Gordon Ball and Luster — are still working next to the MUI (neither company returned our calls).

Records show that once Lennar fired its environmental compliance subcontractor, CH2M Hill, properly installed monitors immediately detected asbestos dust, triggering 15 health-protective shutdowns during the course of the next six months. From these results, is it reasonable to conclude that had Lennar got its monitoring right from the beginning, further shutdowns would have cost Lennar’s construction subcontractors even more truckloads of money, as would have adequate watering of the site, which they didn’t get right for months?

So far, the only explanation for the watering deficiencies has come from Kofi Bonner, president of Lennar Urban for Northern California, who told the Redevelopment Agency, "Given the hilly terrain, it can only be watered enough so as not to create difficult conditions for the workers going up and down the site."

Lennar didn’t finally start to really control its subcontractors until January, when Lennar ordered Gordon Ball and Luster to "replace two site superintendents with new personnel who must demonstrate environmental sensitivity in conducting their work," according to public records.

MIAMI VICE


Headquartered in Miami Beach, Fla., Lennar began in 1954 as a small home builder, but by 1969 it was developing, owning, and managing commercial and residential real estate. Three years later it became a publicly traded company and has been profitable ever since, spinning off new entities.

Lennar Urban is one such venture. Established in 2003 to focus on military-base reuse, Lennar Urban recently produced a glossy brochure in which it proclaimed, "Military base reuse is our business — this is what we do."

Military-base development may be good business — but it isn’t always such a good deal for cities, particularly when communities don’t end up receiving what was promised on the front end.

In November 2006, Lennar announced it wouldn’t build any rental homes in its 1,600-unit development at the Hunters Point Shipyard. The Redevelopment Agency had originally approved a plan for 700 rental units on the 500-acre site, but Lennar said rising construction costs make rentals a losing investment.

Also in November, Arc Ecology economist Eve Bach warned the Board of Supervisors that Lennar’s public-benefits package for Treasure Island could be seriously compromised.

The package includes 1,800 below-market affordable housing units, 300 acres of parks, open space and recreational amenities, thousands of permanent and construction jobs, green building standards, and innovative transportation.

Bach summed up these proposals as "good concepts, uncertain delivery" and noted the discrepancy between Lennar’s stated desire for a 25 percent return and Budget Analyst Harvey Rose’s conservative prediction of an 18.6 percent return.

"Particularly at risk of shortfalls are transit service levels, very-low-income housing, and open-space maintenance," Bach warned.

With community benefits up in the air, high profits expected, and Lennar’s ability to regulate developers uncertain, many community activists question just what San Francisco is getting from the company.

"I can’t say that Lennar is trustworthy, not when they come up with a community benefits package that has no benefit for the community," activist Marie Harrison said. "I’d like to be able to say that the bulk of our community are going to be homeowners, but I resent that Lennar is spoon-feeding that idea to folks in public housing who want a roof over their heads and don’t want to live with mold and mildew but don’t have jobs or good credit or a down payment. I’ve heard seniors say, ‘I can’t even afford to die.’ Lennar is not being realistic, and that hurts my feelings and breaks my heart."

SHOE-IN


The story of Lennar and Muhammed University of Islam underscores the problems with a system that essentially relies on developers to regulate themselves. Bay Area Air Quality Management District records show officials didn’t know monitoring equipment at the site wasn’t working until August 2006, when Lennar discovered and reported the problem.

Lee reported after an Aug. 31, 2006, meeting with CH2M Hill staff, "They were not confident that the air sampling equipment was sampling correctly, due to faulty records and suspect batteries. CH2M Hill staff discovered depleted batteries and could not determine when they drained."

The air district’s air quality program manager, Janet Glasgow, told the Guardian, "The district had never been in this situation before, in which a developer, Lennar, came in and self-reported that they discovered a problem with their monitoring — something the district would never have been able to determine."

Worrisome as Glasgow’s statement is, there’s also the possibility that CH2M Hill’s failures might never have come to light had it not been for the city’s decision to demand another layer of dust controls. As Department of Public Health engineer Amy Brownell said, her inspectors were witnessing trails of dust firsthand, yet CH2M Hill’s monitors kept registering "non-detect" around asbestos.

"Which was suspicious," Brownell told us, "since they were doing massive earthwork."

Saul Bloom, who is executive director for Arc Ecology, a local nonprofit that helps communities plan for base closures and cleanups, told us he recalls "waiting for the first shoe to drop, wondering how there could be no work stoppages when Lennar was digging up a hillside of serpentinite."

The other shoe did drop shortly after the August 2006 meeting. It was black and well polished and attached to the foot of Muhammed, who began questioning whether the dust wasn’t harming his students.

But Muhammed found his questions weren’t easy to answer, given that Lennar had failed to monitor itself and therefore lacked the data that could have proved no harm was done, a scary situation since health problems from asbestos exposure don’t generally manifest themselves until many years later.

Those questions raised others about Lennar and whether it should be trusted to self-regulate.

DÉJÀ VU


In December 2006, Redevelopment Agency Commissioner Francee Covington asked Lennar’s environmental manager, Sheila Roebuck, if the company had any asbestos issues at other projects in the nation. Roebuck replied no, not to her knowledge.

But the Guardian has learned that Lennar already had problems with naturally occurring asbestos in El Dorado. The problems concerned dynamiting in hills that were full of naturally occurring asbestos and resulted in a $350,000 settlement in November 2006. The case involved two El Dorado Hills developers, Angelo K. Tsakopoulos and Larry Gualco, and their earthmoving subcontractor, DeSilva Gates Construction of Dublin.

As part of the terms of the settlement, the county agreed, at the behest of the developers, to make their earthmoving contractor, DeSilva Gates, who provided the dynamite, solely responsible for the settlement. Accused of, but not formally charged with, 47 violations of air- and water-pollution laws is West Valley, a limited liability company composed of Lennar Communities of Roseville, Gualco, and Tsakopoulos’s AKT Investments of Sacramento, with Lennar managing the LLC and AKT acting as the investor.

But as the Sacramento Bee‘s Chris Bowman reported, El Dorado Air Quality Management District head Marcella McTaggart expressed her displeasure directly to Lennar Communities, writing, "We are very disappointed to note that the agreed-upon measures to minimize … dust were completely disregarded by your company."

McTaggart’s words bear an eerie resemblance to Bhatia’s comments about how Lennar’s failure to protect the public heath "hurts trust and credibility."

"Ultimately, I’m very interested in being able to talk to the families and children who believe they have been harmed," Bhatia told us. "I want to help with people’s uncertainties and fears."

LEGAL PROBLEMS


Uncertainty and fear were on display at the Redevelopment Agency’s December 2006 meeting when Muhammed claimed that serpentinite, arsenic, and antimony had been found on his students and staff through "resonance testing."

Lung cancer experts doubt that methodology, telling us the only way to detect serpentinite in bodies is by doing an autopsy.

Following the minister’s claims, a rattled Bonner told the Redevelopment Agency, "Lennar cannot continue to be accused of covering something up or willfully poisoning the community because of profits. Lennar is a national public company, and the accusations and allegations are very serious."

Unfortunately for Lennar and the city, the company’s failures to monitor and control dust have left both entities exposed, since they formed a limited liability company without extensive resources, Lennar BVHP, to conduct the shipyard cleanup.

This exposure became even more evident when Muhammed returned to the Redevelopment Agency Commission in January with 15 MUI students in tow to ask for a temporary shutdown of Lennar’s site until a permanent relocation of the school had been worked out.

"It doesn’t seem proper to have peace discussions while the other side is still shooting," Muhammed said.

His relocation request got Bayview–Hunters Point community activist Espanola Jackson raising more questions: "OK, but where are the other residents going? How can you displace them? Have the residents on Kiska Road been notified? Or on Palou? Nope. You give people dollars to do outreach, but they don’t come to my door. Someone is being paid to not give the truth."

Scott Madison, a member of the Hunters Point Shipyard Citizens Advisory Committee, who’d observed large excavation machines breaking rock but not using water or any other dust controls, said, "I don’t understand how Lennar, who I believe has a sincere interest in doing right, can continue to have a contractor who is out of control."

Bonner explained that Lennar sent notices of default to its subcontractors and hired people from the community to be monitors, plus installed a secondary level of consultants to monitor contractors. But when Redevelopment Agency commissioner London Breed expressed interest in releasing the old contractor and hiring a new one, the agency’s executive director, Marcia Rosen, chimed in.

"Our agreement," Rosen said, "is not with the subcontractor. Our agreement is with Lennar." Her words illustrated the agency’s impotency or unwillingness to crack the whip over Lennar and its subcontractors. But when Lennar Urban vice president Paul Menaker began to explain that its contractors have a 10-day cure period, it was too much for Commissioner Covington.

"We’re way past that," Covington exploded. "We’re not hams!"

EXPLODING HAMS


Perhaps they’re not hams, but the commissioners’ apparent inability to pull the plug on Lennar or its subcontractors leaves observers wondering how best to characterize the relationship between the agency, the city, the community, and Lennar.

Redevelopment Agency commissioners have been appointed either by Mayor Gavin Newsom or his predecessor, the consummate dealmaker Willie Brown. But the incestuous web of political connections goes even further.

Newsom is Speaker of the House Nancy Pelosi’s nephew by marriage. Newsom’s campaign treasurer is another Pelosi nephew, Laurence Pelosi, who used to be vice president of acquisitions for Lennar and now works for Morgan Stanley Real Estate, which holds Lennar stock.

Both Newsom and Laurence Pelosi are connected to lobbyist Darius Anderson, who hosted a fundraiser to pay off Newsom’s campaign debts. Anderson counts Lennar as his client for Treasure Island, Mare Island, the Hunters Point Shipyard, and Candlestick Point, another vast swath of land that Lennar controls.

Brown’s ties to the agency and Lennar run equally deep, thanks in part to Lennar’s Bonner, who was Brown’s former head of economic development and before that worked for the Redevelopment Agency, where he recommended hiring KPMG Peat Marwick to choose between Catellus, Lennar, and Forest City for the Hunters Point project.

KPMG acknowledged all three were capable master developers, but the commission decided to go with the most deep-pocketed entity.

Clearly, Lennar plays both sides of the political fence, a reality that suggests it would be wiser for cities to give elected officials such as the Board of Supervisors, not mayoral appointees, the job of controlling developers.

DAMAGE CONTROL


Under the current system, in which Lennar seems accountable to no one except an apparently toothless Redevelopment Agency, you can’t trust Lennar to answer tough questions once it’s already won your military base.

Asked about asbestos at the Hunters Point Shipyard, Bonner directed the Guardian‘s questions to veteran flack Sam Singer, who also handles PR for Ruby Rippey-Tourk. Singer tried to dodge the issue by cherry-picking quotes, beginning with a Dec. 1, 2006, letter that the city’s health director, Dr. Mitch Katz, sent to Redevelopment’s Rosen.

Katz wrote, "I believe that regulatory mechanisms currently in place for Shipyard Redevelopment are appropriate and adequate to protect the public from potential environmental hazards."

The assessment would seem to be at odds with that of Katz’s environmental health director Bhatia, who has been on the frontline of the asbestos fallout and wrote in a Jan. 25 letter, "The failure to secure timely compliance with the regulations by the developer and the repeated violations has also challenged our credibility as a public health agency able and committed to securing the regulatory compliance necessary to protect public health."

Singer also quoted from a Feb. 20 Arc Ecology report on asbestos and dust control for Parcel A, which stated, "Lennar’s responses have been consistently cooperative." But he failed to include Arc’s criticisms of Lennar, namely that its "subcontractors have consistently undermined its compliance requirements," that it has "not exercised sufficient contractual control over its subcontractors so as to ensure compliance," and that it was "overly slow" in implementing an enhanced community air-monitoring system.

Singer focused instead on Arc’s observation that "there is currently no evidence that asbestos from the grading operation on Parcel A poses an endangerment to human health and the environment."

Lack of evidence is not the same as proof, and while Arc’s Saul Bloom doesn’t believe that "asbestos dust is the issue," he does believe that not moving the school, at least temporarily, leaves Lennar and the city liable.

"They formed a partnership, protective measures didn’t happen, the subcontractors continue to be unreliable, and dust in general continues to be a problem," Bloom told us.

Bloom also recommends the Redevelopment Agency have an independent consultant on-site each day and bar contractors who screw up. "Without these teeth, the Redevelopment Agency’s claims that they have enforcement capabilities are like arguments for the existence of God."

Raymond Tompkins, an associate researcher in the Chemistry Department at San Francisco State University and a member of the Remediation Advisory Board to the Navy who has family in Bayview–Hunters Point, says what’s missing from the city’s relationship with Lennar is accountability, independence, and citizen oversight.

"If you can’t put water on dirt so dust doesn’t come up, you can’t deal with the processes at the rest of the shipyard, which are far more complicated," says Tompkins, who doesn’t want the Navy to walk away and believes an industrial hygienist is needed.

"The cavalier attitude around asbestos dust and Lennar at the shipyard fosters the concerns of the African American community that gentrification is taking place — and that, next stop, they are going to be sacrificed for a stadium." *

How desperate is the pro-car crowd to kill Healthy Saturdays? Sources tell us that De Young Museum matriarch Dede Wilsey and other allies talked rookie Assembly member Fiona Ma into writing state legislation that would have required voter approval for creating car-free spaces in San Francisco parks, and that she was talked out of doing so by financier and backer Warren Hellman — a supporter of Healthy Saturdays — just before the Feb. 23 deadline for introducing bills. Contacted by the Guardian, Hellman confirmed the basic story, telling us, “We talked and she had an idea of proposing something, but I thought it was unnecessary.” He thinks the issue is likely to end up before voters either way, either through a referendum on the passage of Healthy Saturdays or a measure placed on the ballot by four supervisors if it fails. Ma’s office refused to comment on whether she pursued legislation to prevent Healthy Saturdays — which she opposed last year as a member of the Board of Supervisors — and would say only, “I do not discuss private conversations with constituents in the media.”
Saturday closure is an emotion-packed issue for both sides, which may be why Newsom decided to announce his opposition fairly early, just to avoid the acrimony. But that left Sup. Bevan Dufty (who voted against it last year) as the swing vote and someone who admits that his phone has been ringing off the hook lately. But he’s pledged to stay engaged and try to do the right thing: “I’m trying to stay refreshingly open on the issue of Healthy Saturdays and consider different viewpoints.”

Death of Fun Redux

It’s almost fair and festival season in San Francisco, but we’ll see if some actually get a chance to be staged in the neighborhoods where they were born.

The North Beach Festival had a setback yesterday at the Operations Committee of the Recreation and Park Commission. According to festival organizer, Marsha Garland, commissioners Megan Levitan and Tom Harrison expressed concern about alcohol being consumed in city parks and the committee decided to kick the issue up to the full commission. Last year the same issues came up and Garland had made some changes to her proposal — no sale of booze in the park and more fencing of the masses — in order to mitigate concerns that the park and surrounding neighborhood are adversely affected rather during the two days of the festival. Garland and many merchants and citizens consider the festival a boon, bringing additional commerce and attention to their area of the city. An anti-group thinks the hood doesn’t need it.

Meanwhile, the future of the Haight Street Fair is being discussed tonight at the Park Branch Library, from 7 to 9 pm. Some key city and neighborhood planners will be there and it’s sponsored by the HAIGHT ASHBURY NEIGHBORHOOD COUNCIL (For more information, call Karen Fishkin, 921-2032).

“Rust” never sleeps

Between Kirsten Greenidge’s rumbling and ambitious Rust and Chantal Bilodeau’s titilutf8g if more staid Pleasure and Pain, a metatheme is already emerging from the Magic Theatre’s annual three-play Hot House festival. Both Greenidge and Bilodeau merge a contemporary identity-focused story line and a fractured mise-en-scène to explore the porous border between mundane reality and individual and collective fictions.

Rust centers on a troubled patch in the high-flying career of football star Randall Mifflin (Mikaal Sulaiman). The Mighty Miff, to his fans, has temporarily retired for vague reasons having to do with the corruption of the game’s ideals, setting off a controversy embodied by two comically artificial-looking TV sportscasters (Eric Fraisher Hayes and Lance Gardner) complete with navy blue blazers, puffy microphones, plastic hairdos, and even banks of stadium floodlights strapped to their backs. Miff, meanwhile, stays home in edgy seclusion playing video games and collecting antique mammy-shaped cookie jars (and other fixtures of a commercial culture once saturated with antebellum black caricatures). To the growing concern of his wife (April Matthis) and friends (Nicole C. Julien and Donald Lett), it becomes clear Randall is being haunted over the phone by the ghosts of product icons Aunt Jemima, here known as Ella Mae Walker (Cathleen Riddley), and Uncle Ben, or Mr. Peale (L. Peter Callender), who plead with him to deliver the race.

A subplot features a yuppie brother (Gardner) and sister (Matthis) in the process of selling their late parents’ old house. Out of one wall steps a life-size version of Mary-Mary-Anne (Julien), a pickaninny the brother instantly recognizes from childhood as Farina, the cereal icon, one of many racist commercial images their mother bitterly pasted behind the wallpaper in a kind of symbolic burial. Mary-Mary-Anne leads the siblings on a hunt for the cookie jar now in Randall’s possession, as the two plot strands come together — along with an eerie set of lantern-wielding Gold Dust Washing Powder twins, Omas (Lett) and Snipe (Hayes) — in an antique shop operated by a drunken dealer named Gin George (Callender).

Setting these grotesque caricatures in motion among flesh-and-blood moderns is just one of the ways Greenidge’s uneven but vital, imaginative, and ambitious comedy theatrically realizes the uneasy blending of stereotypes and real life. It does so in a way particularly reminiscent of Suzan-Lori Parks’s work. As the enduring force of blackface caricature, and the white supremacist ideology behind it, threads its way into the present day, it becomes clear that the subtle negotiations and compromises attendant on personal and collective identity in 21st-century American culture stand in need of a little schooling, if not an exorcism.

The protagonist in Bilodeau’s Pleasure and Pain has her own problem with private demons bearing down on her social world. Peggy (Jennifer Clare) is an attractive, perky, semiawkward, almost unbelievably sheltered 21st-century young woman groping toward a more or less ’50s-style sexual awakening with an overactive fantasy life she half worries, half hopes will leave her "out of control." Needless to say, she gets her ambivalent wish. Her daydreams — ruled by a strapping dominator (Andrew Utter) dressed in casual S-M gear — soon spill out into her workaday world, which is split between secretarial duties alongside former babysitter and comically unguarded confidant Ruth (a sharp and amusing Catherine Smitko) and a prematurely settled home life with her schluby fiancé (Max Moore).

Not exactly new territory. Pleasure and Pain lacks anything like the imagination — let alone psychological or social import — of Luis Buñuel’s Belle du Jour or even a film by Catherine Breillat. Its limited journey is fairly dull. All the passing allure of bare midriff and lash could have come out of a Good Vibrations catalog circa 1978. *

The latest Presidio disgrace

EDITORIAL Here’s yet another reason why the Presidio national park is a national disgrace:

Way back in 1995, when Rep. Nancy Pelosi was in the process of turning the Presidio over to private interests, we and some other critics asked what the rush was. Sure, money for the new park was tight under a Republican Congress, but that didn’t justify privatizing a national park.

Pelosi’s response: if we don’t let the private sector control the park’s future, the Republicans will just sell it off to the highest bidder.

That struck us as unlikely at the time, particularly since the president, who would have to sign any bill to sell the park, was a Democrat named Bill Clinton. But in retrospect, even if Pelosi’s worst fears had come true, at least the private developers who’d bought it would have had to abide by city zoning rules and state laws.

Instead Pelosi has created the worst of both worlds. As Amanda Witherell reported last week, the Presidio’s special status as a federal enclave means the dozens of private businesses operating there don’t have to abide by California labor laws. And we already knew they didn’t have to follow city or state land-use or environmental laws. In effect, Pelosi has created a private-sector libertarian Wild West in progressive San Francisco, a place where big operators such as George Lucas can avoid taxes and, if they choose, skirt California labor laws, San Francisco’s minimum-wage and health-insurance requirements, and a long list of other workplace protections.

The Presidio isn’t the only national park to face this problem; legal battles over, for example, the right to sell untaxed booze at Yosemite have created a precedent that federal law rules on federal land. But it’s not much of an issue in the rest of the country, because most national parks aren’t business parks and have only modest, if any, private commercial activity going on. Most of the people who work on that federal land are federal employees, who have union contracts that protect them.

And most national parks aren’t right in the middle of crowded urban areas, where businesses right across the street have to obey rules, pay taxes, and act like part of a community.

This isn’t what the late Rep. Phil Burton, whose seat Pelosi now holds, had in mind when he passed a bill requiring that the Pentagon turn the Presidio over to the National Park Service when its days as a military base were done.

There is, of course, a simple fix, and organized labor ought to join the growing chorus of environmentalists putting pressure on Pelosi to get with the program. She needs to repeal the bill that privatized the Presidio, eliminate the requirement that the park pay for itself through commercial ventures, and let it be run like every other national park in the nation.

At the very least, she needs to put through an amendment that requires Presidio businesses — and the Presidio Trust itself — to abide by state and local laws and regulations. *

Will rising seas destroy San Francisco’s sewers? Should condos South of Market be on stilts? Could the huge Coca-Cola bottle at the Giants’ ballpark one day bubble with seawater? Can anyone explain why San Francisco still doesn’t have flood insurance?

As temperatures rise, snow packs vanish, and sea levels surge, San Francisco is waking up to its own inconvenient truth: surrounded on three sides by water, paved with concrete throughout, and erecting condo towers faster than you can say "bamboo," the city by the bay is particularly vulnerable to climate change.

With a recent California Climate Change Center report predicting sea levels will rise between four inches and three feet by 2100, San Francisco can expect increased flooding and damage to vital infrastructure and the destruction of fragile ecosystems and low-lying neighborhoods.

The evidence of impending doom is already there.

Addressing a climate change summit last month, Tom Franza, assistant general manager of the San Francisco Public Utilities Commission, revealed that seawater already tops the city’s weirs for about an hour during very high tides. Franza expects this salt water intrusion, which threatens to kill helpful microbes that digest our solid waste, to get worse as sea levels continue to rise.

So what steps is the city taking to combat climate change?

The SFPUC is already building safety valves on floodgates and pushing for environmentally friendly development toward a future where green roofs, grassy swales, and permeable sidewalks will help stop rainwater from inundating already stressed sewers. It’s also working with the Departments of Planning and Public Works to map blocks and lots that are already sinking — known officially as subsidence — and therefore especially vulnerable to flooding from rising seas.

It comes as a shock to learn that the Planning Department doesn’t already have maps of areas that are prone to floods, but zoning administrator Larry Badiner told the Guardian, "In the past, floods were related to free-running streams, and since there aren’t any in San Francisco anymore, it wasn’t an issue."

Senior planner Craig Nikitas did confirm for us that city planners are working with the SFPUC and the DPW to flag blocks and lots prone to sinking, a phenomenon associated with rising seas that city officials don’t quite understand.

"If I had to guess, I’d say [they’re sinking] because most are on sandy soils or fill and over time there’s been a settling of sand or because of subterranean flooding," Nikitas said.

As the city’s subsidence map shows, the problem is biggest in SoMa and along the bay — where concrete-intense development is on the rise.

In the future, Nikitas told us, "If a developer comes in to do something in those areas, the system will flag it, and builders should pay extra attention to drainage and elevation, using raised entrances three steps up from the street and trench drains and installing sump pumps if there’s a subterranean garage."

As small a step as subsidence mapping sounds, it’s a sea change for city planners. SFPUC principal engineer Jon Loiacono recalls how in the past he was trained to say, "If flooding happens on your property, it’s your problem."

Loiacono remembers only one instance when the SFPUC built a pump station in response to a developer’s concerns. That was almost a decade ago.

Advising developers about the perils of building in flood-prone areas sounds obvious, but with that step comes responsibility that threatens to drown the city fiscally. Asked who’ll pay for flood damage, Loiacono pointed to the Federal Emergency Management Agency.

"FEMA is currently mapping San Francisco, but the city would have to join FEMA’s flood insurance program to get coverage," Loiacono said.

Surprised that the city doesn’t already belong, the Guardian called FEMA’s Oakland-based spokesperson, Frank Mansell, who revealed San Francisco is the only city in the Bay Area that isn’t part of FEMA’s National Flood Insurance Program (NFIP). Participating in the FEMA mapping program would allow residents to qualify for federally subsidized flood insurance and get rebuilding grants after a disaster. FEMA’s Henry Chau says San Francisco will have to raise its standards "slightly higher" to join the agency’s flood insurance program.

Noting that FEMA’s San Francisco map is due this summer and includes development that lies in the city’s floodplains — development FEMA strongly discourages — Mansell said he doesn’t know why San Francisco doesn’t belong. But he does know cities that do must build to code and enact ordinances to ensure people aren’t living in flood zones. He said cities that do build in flood zones must take preventive steps such as raising buildings.

"If cities don’t comply with FEMA’s requirements, they’re put on notice and could be removed from the flood insurance program," Mansell said, adding that disasters such as Hurricane Katrina illustrate why private brokers won’t sell flood insurance.

But as FEMA digitizes and puts its maps online and predicts that 92 percent of US residents will belong to the NFIP by 2010, not everyone is singing its praises. San Francisco Bay Conservation and Development Commission executive director Will Travis faults FEMA’s flood maps for not factoring in climate change.

"Instead, FEMA looks to the past to determine floodplains. As a result, their maps are inadequate and show less inundation than is already occurring," Travis told us. The BCDC just released maps that show a two-meter sea level rise in the bay that would put the San Francisco and Oakland airports and the Giants stadium underwater.

"But we won’t allow the Giants’ ballpark to flood, SFO to be underwater, and San Francisco to become Venice," Travis said. "Instead, sea walls and levees will be built. It’ll require more investment in infrastructure and shoreline protections. The point of the maps is to show people what could happen and get them to take action. Sea level rise doesn’t belong in the realms of science fiction. It’s happening now."

With the California Climate Change Center reporting a seven-inch rise in the bay since 1900 — and the feds refusing to address the role of carbon emissions in climate change — Travis predicted that insurance companies will have the biggest impact in land use planning.

"There’s always an effort to shift costs from the private to the public sector, and from there, from the local to the state to the federal government," Travis told us. "But insurance companies are looking at potential huge losses and won’t be offering policies at all, or offering them at very high prices."

Mansell defended FEMA’s flood maps, arguing that they’re used primarily for insurance and so can’t be used for forecasting.

"We look at existing data," Mansell said. "Otherwise everyone’s premiums would be unpredictable and probably high. FEMA does encourage communities to build to the highest standard, which means the 100-year flood event that has a 1 percent chance of occurring. And FEMA doesn’t conduct the studies. The Army Corps of Engineers does."

Army Corps spokesperson Maria Or confirmed that her agency collects data at different times of the year — data showing the climate has been changing and helping forecast what those changes will mean.

"But we can’t base maps on pure speculation," Or told us. "We continuously look at new data and reanalyze the situation based on that new information. The more relevant question is how often a FEMA map is updated."

Mansell said it takes FEMA one to two years to create a flood map, using computer models, precipitation and tidal patterns, rivers and stream flows — and tracking how much concrete is laid down in an area and how much is built in a floodplain.

"Areas are mapped and remapped and show three levels of risk — low, moderate, and high risk," he said. Based on these ratings, FEMA reviews flood insurance premiums once a year.

But with FEMA the main hope of covering sea rise–related flood damage, experts such as Dr. Peter Gleick of the Oakland-based Pacific Research Institute join the BCDC’s Travis in accusing FEMA of having "failed miserably in integrating climate change into its planning."

"BCDC included climate change in their maps. FEMA did not. Why aren’t there flood maps everywhere around the country that integrate climate change?" asked Gleick, who produced a map 17 years ago showing the impact of a one-meter sea level rise on the bay.

"It’s a little depressing to have been working for two decades on this," Gleick conceded. "I’m glad people are starting to pay more attention and accept that sea level is going up, because the impacts will depend on how we react and how quickly, but we’re decades too late to prevent bad things from happening."

Outraged by President George W. Bush’s we-can’t-afford-to-unilaterally-cut-greenhouse-gases argument, Gleick said, "They’re putting short-term economic gain ahead of long-term survival." But he praised California for establishing a cap to reduce the state’s greenhouse gas emissions to 1990 levels by 2020.

In light of an Intergovernmental Panel on Climate Change report that suggests a 10- to 20-foot sea level increase in the next 1,000 years, Gleick observed, "That means hundreds and millions of people will be potential refugees. So we better reduce our greenhouse gases starting now. We can’t prevent some change, but we hope to prevent disastrous sea level change."

Gleick said he’s worried that we won’t protect low-income areas or move fast enough to prevent damage, a shortcoming that will also have devastating environmental impacts.

"Marshes and wetlands have no place to retreat, since the areas around them are already built up," he explained. "Bay Area communities should make parks, bay and coastal trails, and wetlands bigger, so they’ll have greater protection 50 years from now. And if you’re developing a building that’s supposed to last for 50 years, you need to design it now for the changes that are to come." *

More than clean

Cleaner streets, crack-free sidewalks, an urban landscape unmarred by graffiti and made greener by leafy trees: that was the improved "quality of life" espoused by Mayor Gavin Newsom in his State of the City speech Oct. 26, 2006. And he’s put resources into delivering that pretty picture, with increases to the Department of Public Works (DPW) budget and funds allocated for sidewalk revitalization and the citywide Clean Corridors campaign.

But the city’s top-down approach to realizing the mayor’s goals — and the apparent lack of consideration for the implications of those priorities among ordinary people — has created a backlash from affluent District 7 (where Sup. Sean Elsbernd is upset over the fines being doled out to property owners for cracked sidewalks) to the working-class Mission District (where an aggressive new street cleaning regime has been proposed).

"This is something that just dropped out of the blue, and I think it’s unacceptable," Mission resident Peter Turner said at a Jan. 31 public hearing on the proposal to clean many streets in his neighborhood every weekday. "The city has shown a vast amount of disrespect to the Mission."

Others think there are more pressing problems.

"What is quality of life?" asked Vicki Rega, who lives at 21st and Bryant streets and spoke to the Guardian on her way out of the hearing. "Some trash on your street or a dead kid on your sidewalk?"

The signs started appearing a few weeks ago, posted on trees and lamp poles in the Mission. The type is a tiny 10-point font, often difficult to read through the plastic wrap that holds the paper to the pole. Even if you can make out the words, it’s still pretty unclear that they announce a proposal to ramp up mechanical street cleaning — from as little as one day a week to as many as five.

"The signs were very, very confusing," said Eric Noble, a Shotwell Street resident who was further insulted that postings weren’t made in Spanish and Chinese. "That’s really unconscionable in the Mission."

Beyond warning residents of the radical change to their daily lives, the signs invited them to two public hearings to discuss the issue, on Jan. 31 and Feb. 5. The first hearing drew about 150 residents and frustration that the only sign of officialdom present was DPW representative Chris McDaniels, who was sitting alone behind a vast empty desk, taking notes.

"Who is deciding this issue, and why aren’t they here to hear us?" Judith Berkowitz asked.

Attendees expressed anger at the process and annoyance that car-owning residents on dozens of city blocks east of Valencia Street and north of Cesar Chavez Street will face steep fines and be forced to scramble for new parking spots on a daily basis.

At the beginning of the meeting, the reasons for the change were introduced: illegal dumping in the area had doubled in one year, calls to the city’s trash hotline 28-CLEAN had increased 18 percent from 2005 to 2006, and the sweeper truck in the Mission had been collecting huge amounts of trash.

"It’s the sidewalks, not the streets," several speakers said. They pointed out that the trucks are more successful blowing trash around than sucking it up. Many offered numerous suggestions for how to better clean the streets: have more trash cans and volunteers, employ the homeless, coordinate with other city services, educate the merchants, bring back people with brooms and dustpans — but don’t just run trucks through the streets.

One Alabama Street resident said she’s committed to using public transportation to get to her job in Richmond, but like many others at the meeting, she pointed out that if cars need to be moved five days a week for street cleaning, why not move them all the way to work?

"It’s a disincentive for people to use public transit," she said.

And if they don’t get moved, does the city really mind?

"Is it really trash, or is it revenue?" Shotwell Street resident Eric Noble asked, citing the added opportunities for writing parking tickets. "If revenue enhancement is behind this project, you’re going to see it all over the city."

DPW spokesperson Christine Falvey denied money was the motive and said parking fine revenue goes to the Metropolitan Transit Authority, which has recently revealed an $11 million budget shortfall. Falvey also said changes in street cleaning schedules are usually prompted by complaints from residents, but in this case the proposal was sparked by recommendations from city staff who work in the area.

Street cleaning trucks have been in use since 1976 and currently clean about 90 percent of city streets, but according to Falvey, the DPW has never done an analysis of their efficiency and effectiveness. A consultant was recently hired to make that determination.

"Every time some city agency comes up with an improvement, it does more to inconvenience," David Jayne, a Potrero Avenue resident, told us. "I’m really worried this is another one-size-fits-all cure."

But Newsom has made clean streets a top priority for his reelection year.

"How do we dare to dream big — while not forgetting to fill potholes, clean our streets and parks, and address the small problems of urban life that make such a big difference to our quality of life?" Newsom asked in his State of the City speech.

And how do we do it without pissing off the neighbors?

"You’re not going to find anyone who says, ‘Yeah, I think the neighborhood should be dirtier,’ " Florida Street resident Scott Adams told us. "Things should be done to improve the hygiene of the streets."

But he and others who live on these streets and have watched them for years said they were prepared to push brooms and pick up trash if the city were willing to work on other qualities of life such as rising violence, slipping public schools, and the truly ill transportation system.

The DPW’s stated mission is "improving the quality of life in San Francisco." And that’s been a popular pastime of recent mayors. Frank Jordan had One Neat City Week and the Litter Strike Force. Willie Brown promoted his Spring Cleanings and Great Sweeps. Gavin Newsom touts a goal to make this the "cleanest and greenest city in the country."

So his proposed 2006–7 budget for the DPW’s Street Environmental Services hovers around $33 million, an 11 percent boost over last year. That’s more than the 7 percent increase the patrol unit of the San Francisco Police Department received, the 4 percent Muni Services and Operations received, the 1 percent that went to Child Support Services, and almost two times more than the rise for the housing and homeless budget line in the Human Services Agency.

Street Environmental Services is a fancy-pants term for picking up trash, spraying off pee, and painting over graffiti. The mayor’s most recent plan to achieve this is called Clean Corridors and was unveiled in November 2006 with a $1.67 million allocation from Newsom for targeting the filthy faces of 100 specific blocks throughout the city. (Although this project focuses on the same areas in the Mission, the increased street cleaning is a separate proposal.)

The essence of Clean Corridors is to get residents and business owners to feel more responsible for their property, using both education and fines for things such as cracked sidewalks and dirty facades.

The program also pays for 20 neighborhood ambassadors who each patrol designated areas, picking up trash, reporting graffiti and areas needing repair, issuing litter citations, and educating the public. They’re essentially litter cops.

"He wanted specific people responsible for areas," Falvey said of the mayor’s ambassador program. "He wants that person to own their block."

Yet some residents bristle at Newsom placing such a high priority on litter as the murder rate is spiking, Muni is failing, housing is becoming less affordable, and city hall is mired in dysfunction.

"The war in Iraq. The violence in the streets — that’s probably my number one concern. Public schools. Transportation," Noble said when we asked about his quality-of-life concerns.

"Quality of life means being able to meet the basic necessities of your life," Myrna Lim said. The Excelsior resident is so frustrated with the parking situation in her neighborhood she organized a protest Feb. 24 against any new fine increases. "If you’re on a very tight budget, $40 for a ticket is a lot. When people talk about San Francisco being a very expensive city, that’s part of it. It makes day-to-day living very difficult. Over what? Parking?"

Yet the Mission parking proposal has prompted some community organizing. E-mail sign-up lists were passed around the hearing room, and a healthy chat about the issue now exists at a Yahoo! group. Several residents who aren’t currently members of neighborhood organizations told us they’re thinking about joining or starting one.

"I was quite amazed to see all the people," Noble said of the first hearing and the conversation it sparked. "Maybe one thing that will come out of this is more neighborhood discussions."

The DPW has also been chastened and scheduled an evening meeting in March. "We’ve heard overwhelming support that something needs to be done but overwhelming response that it’s not mechanical street cleaning," Falvey said.

"The city should really be a conduit for people to organize themselves," she added. "For any kind of long-term, sustained effort, it’s got to come from the neighbors." *
