Kim’s affordable housing ballot measure gutted then approved

Housing is out of whack in San Francisco, and Sup. Jane Kim’s affordable housing ballot measure would’ve gone a long way towards fixing it. But that was then. Now, things are more uncertain. 

At yesterday’s [Tues/29] Board of Supervisors meeting, the board unanimously approved Kim’s Housing Balance proposal. But this was not her original ballot measure: it was gutted. Or as Kim told the board, “We were not able to come to an agreement on everything I wanted to see.”

Her originally proposed ballot measure required new housing developments to provide 30 percent affordable housing, with an opt-out mechanism possible through a hearing. Currently, developers can provide on-site affordable housing or pay money into a pot of affordable housing funding. That’s the system we’ve got now, and you can check San Francisco’s soaring rents and home prices to see how well that’s working out.

The 30 percent requirement was a strong, clear ask which may have spurred much-needed housing for middle and lower-income San Franciscans. Too strong, apparently. 

Kim’s negotiations with the affordable housing community and Mayor Ed Lee hit more than a few snags, sources told us. The mayor, frankly, didn’t like it. 

We reached out to the Mayor’s Office but didn’t hear back from them before press time. But it doesn’t take a soothsayer to see the mayor wanted the measure dead: He sent a strong signal by creating a rival ballot measure, which, if approved by voters, contained a “poison pill” which would’ve killed Kim’s measure.

We were still negotiating down to the last minute what we’re announcing today,” Kim told the board. 

Kim’s new ballot measure no longer includes the 30 percent affordable housing requirement. In exchange for dropping the strong mandate, Kim said she wrested a number of concessions from the mayor, including: 

 

  • Pledges of a 33% affordability housing goal for all new development in Central SoMa and future area plans
  • Interim planning controls in the Central SoMa to prevent displacement in advance of the approval of the Central SoMa Plan
  • The creation of a Neighborhood Stabilization Trust to fund Affordable Housing Acquisition & Rehabilitation program
  • Commitment to identify new revenue to accelerate affordable housing projects languishing in the City’s pipeline and land acquisition strategies, including tiered in-lieu fees
  • Pledges to find sufficient funding to jumpstart public housing rehab and HOPE SF –without tapping the Affordable Housing Trust Fund
  • A legislative path forward to continue goals of Housing Balance Act, including unit count

 

Peter Cohen, co-director of the San Francisco Council of Community Housing Organizations, put the compromise this way: What the supervisor ended up doing [through negotiation] is forcing the city to commit itself to substantive policies for real action, in exchange for that conditional use trigger [contained in the original legislation, which would have subjected market-rate projects to addition scrutiny when affordable housing dropped below 30 percent].”

“Obviously,” Cohen said, “some people think thats a bad tradeoff.”

So Kim lost the 30 percent trigger, but gained a number of compromises. So were they a big win for affordable housing advocates? 

Sources told us the Neighborhood Stabilization Trust is a long sought-after goal of the affordable housing community, but so far no plans have been revealed about how the trust (or any of the other proposals) would be funded. The ballot measure may offer Kim some leverage to make sure those promises are funded by Lee, especially considering San Francisco’s impending 2015 mayoral race. 

We’re presenting [voters] a ballot measure that constitutes our core values and memorializes the agreement,” Kim told the board. “Housing balance had a large journey, and it does not stop today. Thirty percent: this is a goal we should commit to as a city. Our voters want this.”

Earlier Tuesday, Kim stood with Lee at the unveiling of 60 new affordable housing units on Natoma street. Now, without a mandate, the only guarantee the city will build more affordable housing is the mayor’s word.

Matthew Curry

Matthew Curry may only be 19, but the burgeoning blues guitarist has already had a career that many musicians spend their entire lives trying to accumulate. The Normal, Illinois native recently came off of a summer tour with Bay Area legends the Steve Miller Band and has already released an acclaimed album made up entirely of originals. His music isn’t just Stevie Ray Vaughan rehashing either — his first disk, Electric Religion, is made up of tracks that explore dynamics, confessional lyricism, and modern production. “Bad Bad Day,” an almost seven-minute jam with prolonged solos by all members of the band, is exhilarating: When Curry comes in on vocals four minutes in, he sounds like a gruff and aged Southern bluesman of the ’50s; he’s that throwback and that mature. Along with his band, The Fury (which is made up of equally talented players who are, on average, about twice Curry’s age), the group is in the midst of a cross-country odyssey that sees them opening for the Doobie Brothers and Peter Frampton. Pretty In Ink

Omar Souleyman

Though Syrian singer Omar Souleyman’s been performing for two decades and allegedly has over 500 releases to his name, you may not have heard of him until recently. Formerly a regular performer at weddings in Syria, Souleyman performs dabke music, meant to accompany the traditional line dance of the same name. Wild videos of these dances and performances found their way onto YouTube and attracted the attention of Seattle label Sublime Frequencies, which released several compilations of his work and brought him to the attention of the world’s music cognoscenti. A Four Tet-produced album and a few inexplicable Bjork remixes later, he’s become something of an underground star, performing for audiences across the world — including in San Francisco, where he’s set to most likely fill The Independent tonight. Xiu Xiu

Twelve albums and 15 years in, Xiu Xiu remains one of the most fearless and uncompromising bands in the American rock underground. Bandleader and songwriter Jamie Stewart speaks to the part of the brain that craves the twisted and taboo, but doesn’t dare make itself known. At best, he’s like that friend you can talk to about just about anything; at worst, he’s like your own fears, screaming in your ears and telling you everything you’re thinking is sick and wrong. As members try to shrug off the stereotype of a “beach band,” there’s something about Real Estate’s mellow guitar pop that resonates with listeners, telling them the band definitely isn’t the modern Jersey equivalent of the Beach Boys. Shaking off a reliance on overdubs, the band recorded almost each take on its newest album, Atlas, live, which bodes well for the Fillmore’s audience tonight. Brainwashing The Ride

Seldom has there been a more romantic musical coupling than that of Katie Ann and MC Zill. Ann, an indie singer who recently recorded her debut album, the heart-wrenching The Ride, at Goo Goo Dolls frontman Robbie Takac’s studio in New York, met the socially conscious Zill (his website is mcofpositivity.com) during her recording process, when she hit his car during a stressful day of outtakes. Their friendship morphed into an engagement, and the duo took to the road to spread their music together. The juxtaposition of Ann’s redemptive lyrics and Zill’s existential queries evoke the power pop/hip-hop mashup of later Eminem. The 2012 release of “Cardiac Arrest” was supposed to be a one-time deal from Bad Suns — the band planned to have only one song to its name. Clap Your Hands Say Yeah

Even Clap Your Hands Say Yeah couldn’t have predicted the impact the unassuming Philly band’s self-titled debut had on the music world when it dropped in 2005. First blogs hopped on the hype, then Bowie and Byrne, then The Office. Seemingly overnight, the band and its leader Alec Ounsworth became one of the most polarizing entities in the indie world, at once beloved and derided for their off-kilter vocals and bizarro art-pop. “I am a survivor of the AIDS epidemic,” Daniel volunteered, beginning to tell us his very San Francisco story.

He was diagnosed with HIV in the 1980s. Working in fine dining rooms of San Francisco hotels at the time, he had health insurance, and had gone to Kaiser for an unrelated procedure. That led to a blood test — and then wham.

“They just bluntly, without any compassion, just told me: You have it,” Daniel said. “Like telling you that you have a pimple on your nose or something.”

All around him, friends were dying from the disease. “I didn’t freak out, because that’s just my personality,” he recalled. “I know a lot of people who have been diagnosed, and they want to take their lives or whatever.”

Today, he’s unemployed and living on a fixed income. He lost his left eye years ago to an infection linked to HIV; he now has a prosthetic eye.

“I’m single, disabled, and low-income,” reflected Daniel, who didn’t want his last name printed due to privacy concerns. Originally from El Salvador, his family came to the U.S. when he was 10 and Daniel has permanent resident status. But despite the disadvantages he faces, Daniel still isn’t freaking out. His medical needs are met.

He got on MediCal after having to drop Kaiser. “And then I ended up at SF General,” he said, “with some of the most professional staff, doctors rated worldwide. It has some of the most professional health care providers for HIV, all in one place.”

Daniel is one satisfied San Francisco General Hospital patient, and he might as well be a poster child for how public health is supposed to work in big cities. Rather than being deprived of primary care and then showing up at the emergency room with preventable complications stemming from his disease, he’s keeping everything in check with regular doctor’s visits — and he can access this high level of care even though he’s on a very tight budget.

There’s a concerted effort underway in the San Francisco Department of Public Health to give more patients precisely the kind of experience Daniel has had, while also expanding its role as the region’s go-to trauma center.

But a difficult and uncertain road lies ahead of that destination, shaped in part by federal health care reform. The new course is being charted amid looming financial uncertainty and with more patients expected to enter the system and the doors of SF General.

Not every General Hospital patient is as lucky as Daniel. For scores of others, SF General is the last stop after a long, rough ride.

 

EMERGENCY CARE

Craig Gordon and Dan Goepel drive an ambulance for the San Francisco Fire Department, regularly charging through congested city streets with sirens blaring as they rush patients to SF General and other care facilities. They see it all: Patients who are violent and psychotic and need to be restrained in the back of the ambulance, folks who’ve just suffered burns or gunshot wounds.

Sometimes, in the thick of all of this, SF General’s Emergency Department is closed to ambulances — in public safety lingo, it’s called being “on diversion” — so the medics will have to reroute to different hospitals.

SF General might go on diversion because the Emergency Department is too slammed to take on anyone new, or because it’s too short-staffed to take on new patients without pushing nurse-to-patient ratios to unsafe levels.

For serious trauma cases, strokes, heart attacks, or traumatic brain injuries, however, the doors are always open. Patients with less-serious cases are the ones to be turned away when the hospital is on diversion.

Patients who wind up en route to SF General in Gordon and Goepel’s ambulance might be living on the margins. “If you’re kind of living on the cusp … you’re not likely going to pursue getting a primary care physician,” Goepel pointed out. “When something comes up, then you find yourself in the emergency room.”

Or their patients might be getting rescued from a spectacularly awful situation, like a plane crash. In this densely populated, earthquake-prone region, there is only one top-level trauma center between Highway 92 and the Golden Gate Bridge: SF General. Anyone in the city or northern San Mateo County unfortunate enough to experience a life-threatening incident — a car wreck, shooting, nasty fall, boating accident — winds up there, regardless of whether they’re rich or poor, indigent or insured. Ranked as a Level 1 trauma center, SF General is equipped to provide the highest level of care.

“In the summer, when school is out, we have a high season of gunshot wounds and stab wounds,” explained Chief Nursing Officer Terri Dentoni, who recently led the Guardian on a tour of the Emergency Department. “When it’s really nice outside, you have a lot of people who get into bike accidents, car accidents. … Last week, we were just inundated with critical care patients.”

Around 100,000 patients flow through SF General’s doors each year, and more than 3,900 need trauma care. On July 6, 2013, when Asiana Airlines’ Flight 214 crash-landed at San Francisco International Airport, more than 60 crash victims were rushed to SF General with critical issues ranging from organ damage to spinal injuries.

“It was a very big tragedy,” Dentoni said. “But it was amazing how many people we took care of, and how well we took care of them.”

Aside from being the sole trauma center, SF General is also designated as the county’s safety-net hospital, making it the only healthcare option for thousands who are uninsured, poor, undocumented, homeless, or some combination thereof. This makes for complex cases. Patients might require translators, be locked in psychiatric episodes, or need a social worker to help them get to a medical respite facility after being discharged if they’re too weak to fend for themselves and don’t have anyplace to go. There isn’t always a place to send them off to.

“We’re seeing people who are dealing with poverty, and often homelessness, in addition to mental health issues,” explained Jason Negron, a registered nurse in the Emergency Department. “You’re seeing patients who often have a number of things going on. Someone who has multiple illnesses — HIV, heart failure, Hepatitis C — even under the best of circumstances, they would be juggling medications. So what happens when they’re out on the streets?”

San Francisco ranks high on the list of health-conscious cities, a haven for organic food aficionados, yoga addicts, and marathon runners. It’s also a world of high stakes struggles and mounting economic pressures. With the city’s skyrocketing cost of living, sudden job loss can spell disaster for someone without a financial cushion. SF General is the catchall medical care facility for anyone who’s slipped through the cracks.

But while rank-and-file hospital staff must tackle grueling day-to-day problems, like how to juggle multiple patients with complex health issues when all the beds are full and the hospital is understaffed, hospital administrators face an altogether different challenge.

For the past several years, the city’s Department of Public Health has been preparing for the implementation of the Affordable Care Act, aka Obamacare, the federal policy that is reshaping the health care landscape. Since public hospitals are mandated to provide safety-net care, they are uniquely impacted by the ACA.

Even with a sweeping new rule mandating health insurance for all, some segment of the population will nevertheless remain uninsured. But they’ll still need medical care — and when health crises come up, they’ll turn to SF General. Trouble is, no one knows exactly how much funding will be available to meet that need as the financial picture shifts.

 

FUNDING CUTS LOOM

Even as ACA aims to increase access to medical care, it’s also going to trigger major funding cuts at the local level. With both state and federal funding being slashed, San Francisco’s county health system stands to lose $131 million in financial support over the next five years, a budgetary hit totaling around 16 percent.

That’s a significant shortfall that will directly impact SF General — but the cuts are being made with the expectation that these gaps will be filled by reimbursements riding in on the waves of newly insured patients enrolled in ACA. Before federal health care reform took effect, around 84,000 San Franciscans lacked health insurance. At the start of this year, 56,000 became eligible to enroll in a health insurance plan.

SF General serves most of the area’s MediCal patients, the subsidized plan for people living on less than $16,000 a year. And since the county gets reimbursed a flat rate for each patient, the expansion of MediCal under federal health care reform will presumably help San Francisco absorb the state and federal funding losses.

“There’s a certain set of patients who previously were not paid for, who now will have MediCal,” explained Ken Jacobs, an expert in health care policy and professor at the UC Berkeley Labor Center.

But there’s a catch. Since MediCal and insured patients will be able to choose between San Francisco’s public system (called the San Francisco Health Plan) and a private medical provider, SF General also runs the risk of losing patients. If too many decide to go with Anthem Blue Cross instead, the system could veer into the red.

“There’s some question of what share of those we’ll keep,” Jacobs noted.

Asked about this, hospital CEO Sue Currin sounded a note of confidence. “Because our outcomes and our quality of care has been so high…75 percent of everyone who’s enrolled in MediCal managed care default to the Department of Public Health,” she told us.

But the journey toward ACA has only just begun, and things are still falling into place. Costs are projected to rise if nothing is done to improve efficiency, while at the same time, the pending state and federal funding shortfalls could take a toll.

Retaining and attracting insured patients is the only way to avoid a resource crunch — but patients could always walk away if they’re dissatisfied. This uncertainty “makes financial planning and management of risk even more challenging,” according to a report issued by the City Controller.

“We don’t know yet today how the Affordable Care Act will impact the safety net,” acknowledged Erica Murray, CEO of the California Association of Public Hospitals, which represents 21 public safety-net institutions throughout the state. “How are these health care systems evolving to be competitive? How do we continue to fulfill our core mission of being the safety net? That is the fundamental challenge. And we don’t know today, and we can’t be certain, that these public health systems will have sufficient funding.”

It’s all “very dynamic,” Murray said. “We don’t have sufficient data to be able to draw any definitive conclusions. It’s just too short of a time to be able to make any predictions. It will take several years.”

For all the newly insured patients under ACA, a certain segment will continue to rely on the safety net. Undocumented immigrants who don’t qualify will be left outside the system. Some individuals can be expected to outright refuse ACA enrollment, or be too incapacitated to do so. Others will opt out of Covered California, the ACA plan for people who make more than about $29,000 a year, because their budgets won’t stretch far enough to afford monthly payments even though they technically qualify. They’ll need safety-net care, too.

Yet under the new regime, “We can’t, as a safety net, go forward only with uninsured patients — because there won’t be funding to sustain the whole organization,” explained hospital spokesperson Rachael Kagan. “We will still have uninsured patients, always. But it won’t be sufficient to serve only them.”

Mike Wylie, a project manager in the Controller’s Office, worked on the city’s Health Reform Readiness project, an in-depth assessment performed in tandem with DPH and consultants. “The million dollar question is: Are we going to be on target with the projections?” Wylie asked.

Instead of standing still, San Francisco’s health system must transform itself, the Health Reform Readiness study determined. Ask anyone who works in health care management in the city, and they’ll tell you that DPH has been working on just that. The idea is to focus on network-wide, integrated care that runs more efficiently.

“We need to switch from being the provider of last resort, to the provider of choice,” Wylie noted, voicing an oft-repeated mantra.

This could mean fielding more patient calls with nursing hotlines, or using integrated databases to improve communication. There’s also emphasis on increasing the number of patients seen by a care provider in a given day. The report urged the department to ramp up its productivity level from 1.5 patient visits per hour, where it currently stands, to 2.25 patient visits per hour. Currin noted that the hospital has also been looking into group patient visits.

“Part of getting ready for health care reform was creating more medical home capacity,” Currin said, referring to a system where multiple forms of care are integrated into a single visit, “so we knew we needed to have better access to primary care.”

If no changes are made, the Health Reform Readiness study found, the city’s General Fund contribution to DPH is projected to rise substantially — to $831 million by 2019, up from $554 million in 2014-15.

“We’re a little concerned about this rising General Fund support,” Wylie noted. And even though staffing represents a major expenditure, “They didn’t assume cuts in staff,” while performing the assessment, he said. “What they’re trying to get is more outputs, more efficiency. The managers went over this and said: in order for us to survive, we’ve got to get more out of our system. We may have to cut money — we may have to cut later, if city leaders don’t commit to this rising General Fund. We’ve got to do all these best practices.”

Throughout crafting this road map, he added, “There were some uncomfortable meetings and uncomfortable moments. But I think [DPH Director] Barbara Garcia got everyone to agree to these strategies.”

Talk to rank-and-file hospital staff, however, and some will tell you that getting more out of the system is a tall order — especially when the system already feels like it’s busting at the seams.

 

SPACE CRUNCH, STRESSED STAFF

“We hit capacity every single day,” said Negron, the RN in the Emergency Department. Patients are regularly placed on beds in the hallways, he said. Wait times for the Emergency Department can last four to six hours, or even longer. The hospital is working on limiting those waits, not just because it’s better in practice, but because timely patient care is mandated under ACA.

“Now, we have 26 or 27 licensed beds in our Emergency Department,” Negron said. But in reality, on a regular basis, “We function with 45 to 50 patients.”

A nurse who works in the Psychiatric Emergency Services unit described her work environment as “a traffic jam with all lanes blocked. This is totally business as usual.”

The workload is on the rise, she added. “The psych emergency room used to see 500 patients a month,” she said. “Now we see 600 patients a month, sometimes more. People are moving faster and faster through the system.”

Her unit is the receiving facility for anyone who is placed on an involuntary psychiatric hold, known as a 5150, for individuals who are a danger to themselves or others or gravely disabled.

“It doesn’t matter who they are,” she said. “We get homeless and destitute. We get CEOs. And we have had CEOs — it’s an experience for everyone involved.” Some patients have been involved in criminal activity. “I’ve had high profile people in my unit; people who have done things that, if I tell you what they did, you would easily be able to Google them.”

Patients who come to her wing need to be evaluated, because someone has determined that they are dangerous. It could be that they are “eating rotten food, or running naked in the street, or suicidal, or want to jump off Golden Gate Bridge, or their family thinks they’re out of control.” Sometimes, patients have to be let go once they’re no longer deemed to be a threat, but they still aren’t altogether recovered, she said.

In the psychiatric inpatient unit, meanwhile, the total number of beds has declined from 87 to 44 in the past five years — leading some staff members to voice concerns.

“There is more to do, and there’s less time to do it,” said another staff member who did not want to be named. This person said one psych unit was essentially shut down and another left open — “but then … a patient climbed up into the ceiling, broke some pipes, and flooded the room” in the open unit, so everything was shifted back to the closed unit.

In part, the daily patient crunch is due to a vacancy rate in the hospital nursing staff that hovers around 18 percent — but steps are being taken to address this problem, caused in part by the city’s Byzantine hiring process.

“The nurses are concerned about how, on a day-to-day basis, they don’t feel they have the support and resources they need,” said Nato Green, who represented the nurses’ union, SEIU Local 1021, in recent contract negotiations. “Staff was expected to do more with less. SF General chronically operates at a higher capacity than what it is budgeted for.”

Currin, the hospital CEO — who started out as a nurse herself — rejected this assertion, saying it is not the norm for the hospital to operate over budget. She added that she would like to reduce the nursing staff vacancy rate down to just 5 percent.

“We have had a fairly significant vacancy rate,” she acknowledged. “But just like any other hospital in the city and the country, you have countermeasures that you put in place to address staffing shortages. And so we use nurse travelers. We use as-needed staff, who work here part-time. We’ve been able to fill those gaps with these other staffing measures. We do want to have a more permanent workforce. We’re working with the city and [DPH] to bring in new hires.”

Roland Pickens, director of the San Francisco Health Network (the patient-care division of the Department of Public Health), said he was working with the city’s Human Resources Department to further streamline operations and get a jump on filling vacancies.

“[Chief Financial Officer] Greg Wagner is working with City Controller’s office and the Mayor’s Office, so everyone is addressing the issue of having a more expedited hiring process,” he said.

Negron, the RN, seemed to think it couldn’t happen soon enough. “For us, at the end of the day, who do we actually have that’s on the schedule, that’s on the floor?” he said. Being fully staffed is important, he added, “so we don’t have any more shortages. So we don’t close beds, or go on divert unnecessarily.”

Staff members, who deal hands-on with a vulnerable patient population, lament that there doesn’t seem to be enough resources flowing into the system to care for people who are at the mercy of the public safety net. After all, San Francisco is a city of incredible wealth — shouldn’t there be adequate funding to care for the people who are the most in need?

“Poor people are not profitable,” Green said. “Without regulatory intervention, poor people would not have adequate health care.”

 

EVOLVING INTO THE FUTURE

For all the concerns about staffing and the financial uncertainty caused by ACA, SF General still has plenty to brag about. For one, it’s moving into a brand new, nine-story facility in December 2015, which will be equipped with a seventh-floor disaster preparedness center and nearly twice as much space in the Emergency Department.

It will have 283 acute care beds, 31 more than there are now. Most of the patient rooms will be private, and the new hospital will be seismically sound — a critical upgrade in a city prone to earthquakes. The hospital construction was funded with an $887.4 million bond approved by voters in 2008.

“In a new care environment, it will be more comfortable for the patients and the staff,” Currin said. “It’s just a much better environment. We’re hoping with the expansion … the wait times [in the Emergency Department], instead of taking four to six hours, we’re hoping to decrease that by 50 percent,” she said. “There will be more nurses, physicians, housekeepers.”

Pickens, the Health Network director, said he felt that “the stars had aligned” to have the hospital rebuild nearing completion just as ACA gets into full swing, since the new facility can help attract the patients needed to make sure the health system is fully funded.

The hospital has also launched an initiative to reduce patient mortality linked to a deadly infection. “Sepsis is a reaction the body has to a severe infection,” explained Joe Clement, a medical surgical unit clinical nurse specialist. “It causes organ dysfunction, and in some cases death. It’s very common, it’s growing, there’s more and more of it every year, and about a third of hospital deaths have been associated with sepsis in some way.”

In 2011, SF General began implementing new practices — and successfully reduced the hospital mortality rate from 20 percent in 2010 to 8.8 percent in 2014.

SF General was also recently lauded in The New York Times for being a top performer in quality and safety scores for childbirth. In San Francisco, low-income women who may be uninsured and dealing with harsh life circumstances can nevertheless get full access to multilingual doctors, midwives, lactation consultants, and doulas. The World Health Organization has even designated it as “Baby Friendly,” because of practices that support breastfeeding.

As things move ahead, management is projecting a sense of confidence that SF General’s high-quality care will allow the hospital to attract patients and maintain a healthy system that can continue to support the insured and uninsured alike.

“Value, we usually define as improving health outcomes, and optimizing the resources we have, for as many people as we can,” said William Huen, associate chief medical officer.

Speaking about the sepsis initiative, he said, “This is kind of our model program of, how do you focus on one area where you know you can improve health outcomes, with integration throughout the system, education at every level … and then having the data and perfecting the care. That can be applied to anything. So as a system, I think we’ve developed infrastructure to support that type of work.”

But for the staff members who are actively involved in the union, it continues to be a waiting game to see if the promises of new staffing levels are realized. Until then, many have said that the low staffing levels are a threat to patient safety. “They are waiting to see if DPH lives up to its commitment to hire the people they said they were going to hire, and staff it at the level they were going to staff at,” Green said.

It all comes down to providing care for people who really have nowhere else to turn, Negron told us in the Emergency Department. “I’m sure we see the highest portion of uninsured patients in the city,” he said. “We’re doing that in many different languages, with people from all over the world. I feel like it’s a real honor to be able to work there in that context. I feel honored to meet a need — that’s not always able to be met.”

Homeless in transit

For most people, the Bay Area Rapid Transit system’s stations are just that: transitory. Walk into Powell Station, zip down the escalator and glide out on a train, destination somewhere. But for homeless people drawn to BART stations, the agency is a place to be stationary, a home and safe haven from the elements, muggings, and other hazards of sleeping on streets.

But now, BART intends to reclaim the T in its name. It wants the homeless to be transitory and get out of the stations.

Last week, the agency announced new enforcement of existing safety regulations that ensure people can evacuate a BART station in an emergency. BART argues homeless people sleeping or sitting in BART station hallways are in the way of a swift evacuation.

This legal interpretation gave BART carte blanche to scoop the homeless up and out. On the first day of the new rules, 17 homeless people were removed from Powell Station, which the agency justified to news media by repeatedly showing a video of a smokey accident that sent passengers fleeing.

“We had places where a big puff of smoke would fill the station very quickly,” Jeffrey Jennings, BART Police’s deputy chief, told the Guardian. “People were running not knowing what happened, very fearful. Other people were lying down, tripping folks. We could have had significant injuries occur because of that.”

First time offenders get a verbal warning, the second offense garners a citation, and the third offense jail time, all in the name of safety.

But the idea that homeless sleepers in all parts of a BART station may be trampled seems a little silly. Sure, there are sections of BART that are narrow and should be kept clear, but a walk through Powell Station shows 20-foot wide hallways throughout. This is where the homeless often sleep and sit.

At 8pm on a Wednesday, Powell Station is quiet and mostly empty, except for Charles T. He’s sitting in a chair right by the Powell Street entrance, strumming a guitar (skillfully), singing Otis Redding’s “Dock of the Bay.”

His voice is a dead ringer for Redding’s: “Sitting on the dock of the Bay, wasting my good time… I have nothing to live for, looks like nothing’s going to come my way. So I’m just going to sit on the dock of the Bay.”

Some still sat in Powell Station that night, flouting the new ban. A woman in baggy clothes sat by the Fourth and Market streets stairwell, cuddling her very big, very droopy-faced Rottweiler. A bald man in soiled gray pants sat along the hallway to the next exit. Slightly past him lay a man with long black hair snoring next to the wall. And at the end of that hallway, two men stayed in each other’s orbit: a slender one in a red jacket and blue jeans slept with his dirt-caked hands folded over his stomach, while a portly man sat nearby on cardboard boxes, tapping his fingers to a silent tune.

The last man we saw sat with his feet pulled under his knees by the entrance to the Westfield Centre, studiously reading his Bible as he underlined passages from Revelations. The would-be scholar, Henry Terry, 59, greeted us with a smile.

Terry was born in Los Angeles, a child of Watts who was a kid during the violent 1965 riots when 34 people died, over 1,000 people were injured, and the neighborhood burned. Terry’s mother sent him to Alabama with his father.

Terry fondly recalls growing corn, peas, watermelon, okra, squash, and sugar cane. That’s food he doesn’t have ready access to nowadays.

After bouts with the bottle and drugs, Terry cleaned himself up and got a place to live at the Hotel Essex, part of the city’s Community Housing Partnership. But alcohol lured Terry back. While in rehab, he missed an important court date, and he was evicted.

Now he spends his nights holding his Bible sitting in a BART station, seeking guidance and shelter. “The only thing getting me back to functioning is reading God’s word,” he said.

Terry’s already been ousted due to BART’s new rules. But on this day, some of the officers were more lenient. “[The officer] told me to cross my legs the entire time I’m here,” he said, “so people walking don’t trip over you.”

They also asked him to leave the commuters be. “I don’t ask for food or money,” Terry said. He just wants shelter until he can appeal his eviction.

Counterintuitively, BART Police officers who already threw Terry out once are the reason he stays there. He said the streets are dangerous, and muggings by other homeless people are common. The gates to the station go down at 12:30am, and Terry sleeps next to them because he knows the BART police will keep the muggers away.

BART argues the new rule is about safety of the passengers. California Building Code 433.3.2.2 states, “There shall be sufficient means of exit to evacuate the station occupant load from the station platforms in four minutes or less.”

Though Terry was glad the officers left him alone to sit, the Guardian saw BART police apply the law to other homeless people: usually the ones mumbling to themselves, or, frankly, the dirtiest ones.

The two men in each other’s orbit were ousted. One tall and broad-shouldered officer woke the man sleeping in the red jacket.

“Excuse me sir, excuse me. Do you know about the new rules at BART?” he asked. After explaining the ban, he said “This is the first time, so I’ll give you a warning, the second time I will cite you. The third time, you go to jail.”

The officer recommended services they could call, together. He spoke kindly, even sweetly, but the result was the same as if he had been cruel: The man in the red jacket picked up his cardboard and went out into the streets.

We told Deputy Chief Jennings about the apparent selective enforcement, questioning the law had anything to do with safety. From our four hours of observation at Powell Station, it seemed to be applied only to the dirtiest or rowdiest people, or the ones specifically sleeping, we told him.

“Our policy is someone needs to be conscious, awake, and aware of their surroundings,” Jennings told us. “There’s no selective enforcement. We only have so many officers, so officers will be drawn more to someone who is not being quiet, or having a problem.”

He also told us they had never enforced the building code before because no one had ever thought to, until the idea occurred to a newly promoted sergeant.

To its credit, BART is making inroads to help the homeless. First, transit officials went to Bevan Dufty, the director of the Mayor’s Office on Homelessness.

“I was honest and said we don’t have on demand resources and our shelters are full,” Dufty told us. The Homeless Outreach Team is stretched to the limit. Dufty suggested BART hire its own help, which it did.

Its first full time Crisis Intervention Training Coordinator, Armando Sandoval, helps pair the homeless at BART stations with housing and other services. He targets his efforts on what BART calls its 40/40 list, which tracks the 40 homeless people that generate the most service calls to BART police. A BART press release said it placed 22 people with services within the last year.

“[Sandoval] hunts them down to see if he can work his magic with these folks,” Jennings said.

Supervisor Jane Kim is working with Dufty’s office to revamp BART’s new policy. “They clearly stretched safety concerns,” Kim told us. “It’s one thing to offer services, but another to force people out.”

BART’s Quality of Life service calls doubled from 2013 to 2014, according to a BART quarterly report, generated by complaints like public urination and disturbing the peace.

A BART police officer, who did not want to be named, told us he thinks BART has a hard choice: to let riders feel harassed and unsafe, or to oust people clearly in need of compassion. He said he saw the homeless population in the station swell with “the weather and the economy.”

“We have to do what we have to do,” he told us. But on the other hand, he said, “It’s not against the law to stink.”

He’s half right. Though being homeless and dirty may not be illegal, it may get you thrown out of a BART station.

People are talking about this article from Sunday’s San Francisco Chronicle about how much three fall ballot measures will cost the city, but many progressives and political outsiders are more focused on the juicy details lower down in the article about the spiteful, bullying political tactics practiced by the Mayor’s Office these days.

Mayor Ed Lee and his top aides are said to be “fuming” that Sup. Scott Wiener and five of his colleagues placed a measure on the fall ballot that would give Muni more money as the city’s population increases — and that “the mayor’s office seems to be hinting that it will target programs important to the six supervisors who voted to place Wiener’s proposal on the ballot.”

The measure is retroactive to 2003, the last time Muni had an increase in its funding from the city General Fund, so it would mean an immediate funding bump of $20 million or more, which the mayor is disingenuousnessly casting as budget buster. Keep in mind this same mayor unilaterally ended Sunday meters this year, costing Muni about $10 million a year, and supports corporate welfare programs that cost the city $17 million last year.

This spiteful and retaliatory approach to public policy by Lee, the elected official with the most control over the city’s pursestrings, and his minions was also a big factor in Sup. Jane Kim’s capitulation to the Mayor’s Office on her housing balance measure. Sources tell the Guardian that affordable housing advocates were threatened with reduced city funding from the Mayor’s Office if they continued to push for Kim’s original measure.

The Chronicle article was based largely on a Controller’s Office memo claiming the three ballot measures — the Muni measure, a proposal to increase the minimum wage to $15 by 2018, and reauthorization of the Children’s Fund — would be the “largest voter-directed increase in general fund spending in a single election in city history,” costing $104 million by 2018.

More than half of that is from the minimum wage increase, which will increase the city’s cost of contracting low-paid nonprofit workers to perform public services. But in this increasingly expensive city, does anyone really think $15 per hour is an unreasonable wage? Should the city itself be exploiting workers?

After the city recently slashed building and planning fees charged to developers, and in a city that continues to coddle big corporations and landlords rather than tax them fairly, the Mayor’s Office ire over policies that help low-wage workers and Muni riders is particularly telling of its values and priorities.  

Exposing PG&E’s other “cozy relationship,” with Mayor Ed Lee

News outlets from Sacramento to Los Angeles are crowing about Pacific Gas & Electric Company’s alleged “cozy relationship” with the utlity that oversees it, the California Public Utilities Commission.

At least 41 emails obtained by the city of San Bruno reveal an intimate, friendly arrangement between the monopolistic power company and the regulators that are supposed to keep them in line. Where the public would expect a separation as hard and fast as church and state, the emails reveal a buddy-buddy relationship.

This is of no surprise to long-time Guardianistas, who may remember Rebecca Bowe’s cover story three years ago “The secret life of Michael Peevey, [5/11]” chronicling the CPUC president’s extravagant trips to Madrid, Spain and Germany with top energy officials, as well as other activities that may seem strange for an official who’s supposed to be a watchdog against PG&E malfeasance.

But if world-trekking trips to pricey hotels aren’t enough to raise eyebrows about the relationship between PG&E and its regulators, now we have suspicious emails to add to the pile.

As the San Jose Mercury News revealed:

In an April 2013 email, Carol Brown, chief of staff for Commissioner Peevey, wrote to PG&E executive [Laura] Doll and offered advice about how to handle one of the proceedings related to the San Bruno explosion. In the email, Brown said she had talked to one of the PUC administrative law judges about the matter.

“Send back a sweet note” to the PUC about the matter “and then wait for them to throw a fit” was part of Brown’s advice. Brown also said she was “happy to chat” about the matter with PG&E to help guide company officials through the PUC process.

Doll replied to Brown, “Love you. Thanks.”

Even Peevey himself emailed PG&E, offering them public relations advice. It’s like an umpire sneaking around between innings to coach a first-baseman — unseemly, and totally strange.

All of this should ring alarm bells in The City. The city of San Bruno obtained the emails through settlement of a lawsuit, which are now revealing potential corruption at top levels of the CPUC. But here in San Francisco, Mayor Ed Lee flouts public records laws and, as we revealed, drafted a policy allowing him to delete his own emails.

There’s no way we can check what Lee is saying to PG&E in emails, making exposing any alleged “cozy relationship” much more difficult than PG&E’s alleged romance with the CPUC.

And the consequences for The City are very real, as well as potentially fatal. As we’ve covered before, there are PG&E pipelines aplenty in San Francisco (including one right along Bernal Hill). When San Bruno’s pipeline exploded, eight lives were lost and many more homes destroyed.

As the San Francisco Chronicle reported last month (and as we’ve said for years), Lee already has suspiciously close ties with PG&E.

However, multiple city officials say that Lee’s administration has consistently, and quietly, raised objections about legislation and policies that PG&E opposes. They also point to the utility’s charitable giving to the city and some of Lee’s pet projects as an example of how PG&E tries to exert its influence.

Critics of Lee’s relationship with PG&E extend from the political left to at least five current and former high-level city officials. In some cases, several of the sources said, that relationship appeared to be inappropriate. PG&E officials regularly went to the mayor’s office when they were unhappy with city staff members, said the sources, who requested anonymity because of their relationship with the mayor.

“They were in his office all the time, meeting with either the mayor or his staff, and seemed to directly intervene in city decisions,” said one official. “It isn’t normal for most businesses in the city to always have meetings with the mayor.”

Lee, in several interviews, dismissed the idea that he was doing PG&E’s bidding as “a little off base.”

“I look at PG&E like any other company in the city,” Lee said. “I don’t think I have any special relationship with them.”

But in the case of the mayor, we may never know how close he is with the utility, as long as his off-kilter public record laws allow him to delete any paper trail. The CPUC is discovering what Lee long ago learned from former-Mayor Willie Brown: The “E” in e-mail stands for “evidence.”

Housing ballot measures would weaken city policy

EDITORIAL Under the misleading guise of encouraging the development of more affordable housing in San Francisco, Mayor Ed Lee and Sup. Jane Kim have sponsored a pair of fall ballot measures that actually weaken existing housing policy in San Francisco. It’s a ruse that shouldn’t fool politically savvy San Franciscans.

Lee has the authority to place his Build Housing Now measure on the ballot, although he may withdraw it under his backroom deal with Kim. But the Board of Supervisors should reject Kim’s City Housing Balance measure, a once-promising proposal that she last week made toothless and counterproductive. What she called a “compromise” was actually a capitulation to developers and the Mayor’s Office [Editor’s Note: The board was scheduled to consider Kim’s measure on July 29 after Guardian press time, which is why we posted this editorial early at sfbg.com, where print readers can check for an update].[UPDATE: The board unanimously approved the amended measure.]

Kim’s original measure called for market-rate housing developers to get conditional use permits and perform additional economic studies on their projects when affordable housing production falls below 30 percent of total production. She then weakened it with several exemptions, yet it was still a check against runaway development of luxury housing.

But her new measure, much like Lee’s, is little more than a wishful policy statement calling for the city to seek the goal of 33 percent of housing affordable by moderate income San Franciscans and below (usually defined as those making 120 percent of area median income or less) and 50 percent by the more vaguely defined “working middle class.”

While neither measure includes any enforcement or funding mechanism to help reach that goal, it’s noteworthy that the goals themselves weaken those the city set for itself in the Housing Element of the General Plan, which call for 60 percent of new housing construction to be affordable to those with moderate incomes and below. The board adopted an amended version of this Housing Element just last month.

This is politics at its very worst: Politicians claiming to be doing one thing in order to score points with voters and appear responsive to their concerns, while they actually do just the opposite and try to disguise that fact with disingenuous rhetoric.

Kim’s allies in the labor and progressive political communities tell us they’re disappointed in her capitulation at such a crucial moment in determining whether San Francisco becomes a city of the rich or whether it can retain its socioeconomic diversity.

We were also disappointed, although we weren’t surprised. There’s an ugly, money-driven brand of politics being practiced at City Hall these days, and Kim has repeatedly shown herself to be more concerned with her future political prospects than living up to the progressive values she has long espoused.

Will San Francisco voters give Muni more money to serve a growing population?

Beating up on Muni and the San Francisco Municipal Transportation Agency is a perennial pastime for many San Franciscans, who will be given the opportunity to put their money where their mouths are this November. Will they be willing to give Muni the money it needs to serve its growing ridership, even at the cost of other city programs and priorities?

The Board of Supervisors yesterday [Tues/22] voted narrowly to place Sup. Scott Wiener’s Muni funding measure on the fall ballot. It would increase General Fund contributions to the SFMTA as the city population increase, retroactive back to 2003 when the current rate was set, giving the agency an immediate $20-25 million boost to serve the roughly 85,000 new residents the city has added since then.

“For too long City Hall has been slow to prioritize transit funding,” Wiener said in a press release. “We are a growing city, and we need to take firm steps to ensure that our transportation system keeps up with that growth.  Improving transit reliability and capacity and making our streets safer are key to that goal.”

While everyone says they support Muni — even David Looman, the proponent behind the Restore Transportation Balance initiative that seeks more SFMTA funding for cars, which will also appear on that ballot — Wiener has been the rare strong advocate locally for actually giving the agency more money.

Mayor Ed Lee created a $10 million hole in the SFMTA budget by demanding the repeal of charging for parking meters on Sunday this year, and then he dropped his support for a local increase in the vehicle license fee this year, prompting Wiener to introduce his Muni funding measure, which the mayor would have the authority to terminate if voters approve a VLF increase in 2016.

A $500 million general obligation bond transportation measure backed by Lee and the full Board of Supervisors will also appear on the November ballot, but it will go mostly to cover Muni’s capital needs, not the growing demands on its operating budget.

Wiener’s Muni funding measure yesterday barely got the six votes this charter amendment needed to qualify for the ballot: those of Wiener and Sups. London Breed, David Campos, David Chiu, Malia Cohen, and Jane Kim (Sup. John Avalos was absent).

In recent years, there’s been a rift in the city’s progressive coalition between environmental and transportation activists on one side and affordable housing advocates on the other, who sometimes battle over city funding they see as a zero sum game. So it will be interesting to watch how the politics surrounding this measure shape up going into the fall campaign season.  

King of the commons

When Susan King attends the Aug. 24 Sunday Streets in the Mission District — the 50th incarnation of this car-free community gathering, coming the week before her 50th birthday — it will be her last as director of an event she started in 2008.

That successful run was made possible by King’s history as a progressive community organizer who also knew how to do fundraising, a rare combination that has made Sunday Streets more than just a bicycle event, a street faire, or a closure of streets to cars that the city imposes on its neighborhoods on a rotating basis.

Instead, King took the ciclovia concept that started in Bogota, Colombia in the late ’70s — the idea was creating temporary open space on streets usually dominated by cars (See “Towards Carfree Cities: Everybody into the streets,” SFBG Politics blog, 6/23/08) — and used it as a tool for building community and letting neighborhoods decide what they wanted from the event.

“I regard the organizing as community organizing work rather than event organizing, and that’s significant,” King told the Guardian. “We’re creating the canvas that community organizations can use.”

San Francisco was the third US city to borrow the ciclovia concept to create open streets events — Portland, Ore, was the first in June 2008, followed quickly by New York City — but the first to do one that didn’t include food trucks and commercial vending, which Sunday Streets doesn’t allow.

“It’s not a street fair, it’s about meeting your neighbors and trying new things,” King said, referring to free activities that include dance, yoga, and youth cycling classes and performances. “It’s a really different way of seeing your city. A street without cars looks and feels different.”

Now, after seeing how Sunday Streets can activate neighborhoods and build community, and watching the concept she helped pioneer be adopted in dozens of other cities, King says she’s ready for the next level.

“I want to apply what I know on a larger scale, ideally statewide,” King said of her future plans. “This really opened my eyes up to the possibilities.”

 

WORKING WITH COMMUNITIES

After a lifetime of progressive activism — from grassroots political campaigns to city advisory committees to working with the Green Party — King knew the value of listening to various community stakeholders and earning their trust.

“We try to be culturally competent and work with each neighborhood,” King said. “We want to work with the neighborhood instead of dropping something on the neighborhood.”

That distinction has been an important one, particularly in neighborhoods such as Bayview and the Western Addition, where there is a long history of City Hall officials and political do-gooders trying to impose plans on neighborhoods without their input and consent.

“We worked really closely together and she gave me a lot of leeway to do Sunday Streets in a way that it worked for the community,” said Rebecca Gallegos, who managed public relations for the Bayview Opera House 2010-2013. “I can’t say enough great words about Susan. She was a truly a mentor to me. They’re losing someone really great.”

The first Sunday Streets on Aug. 31, 2008, extended from the Embarcadero into Bayview, opening up that neighborhood to many new visitors. King cited a survey conducted at the event showing 54 percent of respondents had never been to Bayview before.

“Susan wore a lot of hats. Not only did she create community in all the neighborhoods in San Francisco, but she knew how to go after the money,” Gallegos told us. “She walks the walk and doesn’t just talk the talk.”

Meaghan Mitchell, who worked with the Fillmore Community Benefits District, also said King’s skills and perspective helped overcome the neighborhood’s skepticism about City Hall initiatives.

“Susan came in and was very warm and open to our concerns. She was a joy to work with,” said Mitchell, who went on to work with King on creating Play Streets 2013, an offshoot of Sunday Streets focused on children.

The neighborhood was still reeling from a massive redevelopment effort by the city that forced out much of its traditional African American population and left a trail of broken promises and mistrust. Mitchell said King had to spend a lot of time in community meetings and working with stakeholders to convince them Sunday Streets could be good for the neighborhood — efforts that paid off as the community embraced and helped shape the event.

“It was nice to know the Fillmore corridor could be included in something like this because we were used to not being included,” Mitchell told us. “Community organizing is not an easy job at all because you’re dealing with lots different personalities, but Susan is a pro.”

 

ROUGH START

It wasn’t community organizing that got King the job as much as her history with fundraising and business development for campaigns and organizations, ranging from the San Francisco Symphony to the San Francisco Women’s Building.

At the time, when city officials and nonprofit activists with the Mode Shift Working Group were talking about doing a ciclovia, King was worried that it would get caught up in the “bike-lash” against cyclists at a time when a lawsuit halted work on all bike projects in the city.

“I thought that would never fly,” King said. “We started Sunday Streets at the height of the anti-bike hysteria.”

But her contract with WalkSF to work on Masonic Avenue pedestrian improvements was coming to an end, she needed a job, and Sunday Streets needed a leader who could raise money to launch the event without city funds.

“I know how to raise money because I had a background in development,” said King, who raised the seed money for the first event with donations from the big health care organizations: Kaiser, Sutter Health/CPMC, and Catholic Healthcare West. And as a fiscal sponsor, she chose a nonprofit organization she loved, Livable City, for which Sunday Streets is now a $400,000 annual program.

King had a vision for Sunday Streets as an exercise in community-building that opens new avenues for people to work and play together.

Immediately, even before the first event, King and Sunday Streets ran into political opposition from the Fisherman’s Wharf Merchants Association, which was concerned that closing streets to cars would hurt business, and progressive members of the Board of Supervisors who were looking to tweak then-Mayor Gavin Newsom, whose office helped start the event.

City agencies ranging from the Police Department to Municipal Transportation Agency required Sunday Streets to pay the full costs for city services, something that even aggressive fundraising couldn’t overcome.

“We were in debt to every city department at the end of the second year. It was the elephant in the room going into that third year,” King said.

But the Mayor’s Office and SFMTA then-Director Nat Ford decided to make Sunday Streets an official city event, covering the city costs. “It was the key to success,” King said. “There’s no way to cover all the costs. The city really has to meet you halfway.”

King said that between the intensive community organizing work and dealing with the multitude of personalities and interests at City Hall, this was the toughest job she’s had.

“If I would have known what it would be like,” King said, “I would never have taken the job.”

 

SUNDAY STREETS SOARS

But King had just the right combination of skills and tenacity to make it work, elevating Sunday Streets into a successful and sustainable event that has served as a model for similar events around the country (including at least eight others also named Sunday Streets).

“The Mission one just blew up. It was instantly popular,” said King, who eventually dropped 24th Street from the route because it got just too congested. “But it’s the least supportive of our physical activity goals because it’s so crowded. It was really threatening to be more of a block party.”

That was antithetical to the ethos established by King, who has cracked down on drinking alcohol and unpermitted musical acts at Sunday Streets in order to keep the focus on being a family-friendly event based on fitness and community interaction.

Even the live performances that Sunday Streets hosts are required to have an interactive component. That encouragement of participation by attendees in a noncommercial setting drew from her history attending Burning Man, as well as fighting political battles against the commercialization of Golden Gate Park and other public spaces.

“It was my idea of what a community space should look like, although I didn’t invent it…We really want to support sustainability,” King said. “We’re not commodifying the public space. Everything at Sunday Streets is free, including bike rentals and repairs.”

As a bike event, the cycling community has lent strong support to Sunday Streets, with the San Francisco Bicycle Coalition strongly promoting it along the way.

“The success of Sunday Streets has been a game changer in showcasing how street space can be used so gloriously for purposes other than just moving and storing automobiles. At every Sunday Streets happening we are reminded that streets are for people too,” SFBC Director Leah Shahum told us. “Susan’s leadership has been such an important part of this success.”

DA LOBBYIST

Former San Francisco Mayor and current Chronicle columnist Willie Brown, often just called Da Mayor, is widely acknowledged to be one of the most politically influential individuals in San Francisco. But until recently, he’d never registered as a lobbyist with city government. Now it’s official: Brown has been tapped as a for-real lobbyist representing Boston Properties, a high-powered real-estate investment firm that owns the Salesforce Tower. News outlets (including the Bay Guardian) have pointed out for years that despite having received payments for high-profile clients, Brown has never formally registered, leaving city officials and the public in the dark. Da Mayor, in turn, has seemed unfazed.

GAZA PROTEST

On July 20, marked as the deadliest day yet in the Israeli-Gaza conflict, hundreds of pro-Palestinian protesters gathered in San Francisco to march against the ongoing violence. Waving flags, participants chanted “Free, free Palestine!” and progressed from the Ferry Building to City Hall. It was just one of hundreds of protests staged worldwide in response to the bloodshed. PET CAUSE

Last year, the SF SPCA (www.sfspca.org) assisted with over 5,000 cat and dog adoptions. With its new adoption center near Bryant and 16th Streets, which opened June 13, it aims to increase capacity by 20 percent — saving 1,000 more furry lives in the process. The new facility features improved condo-style enclosures rather than cages, a small indoor dog park, and SF-themed climbing structures for cats. (So far, there’s a Golden Gate Bridge, a Transamerica Pyramid, a cable car, the Sutro Tower, and the SF Giants logo; a Castro Theatre design is in the works.) These improvements make the shelter life more comfortable for the animals, but they also help entice visitors, making the adoption process “a fun, happy experience,” says SF SPCA media relations associate Krista Maloney. This week San Francisco plays host to the Libertarian conference/slumber-party Reboot 2014, aimed at — you guessed it — tech workers. Conservatives and government-decrying libertarians are natural allies, wrote Grover Norquist, scion of the anti-tax movement, in the pages of the Wall Street Journal. Uber swerves around transportation regulations, Airbnb slinks under housing regulations. It’s no wonder politically marginalized libertarians are frothing at the mouth to ally with Silicon Valley’s ascendant billionaires. Reboot 2014 speaker Rand Paul’s recent meeting with Mark Zuckerberg, Sean Parker, and Peter Thiel should have liberals all worried.

BART CLEANSING

BART announced via a press release they’d begin “ensuring safe evacuation” of downtown BART stations. By this they mean they’ll start sweeping out anyone sitting or laying down in the stations, clearly targeting the homeless. Deflecting those accusations, BART said they are one of the few transportation agencies with a dedicated outreach and crisis intervention coordinator, as if that gives them a pass.

SF and UC systems dragging their feet on fossil fuel divestment

The San Francisco Employees’ Retirement System and University of California Board of Regents — two local entities targeted by campaigns urging them to divest of their fossil fuel investments — remain resistant to the change despite official statements of support.

In April of last year, the San Francisco Board of Supervisors voted to push SFERS to divest from fossil fuels. Now, more than a year later, sponsoring Sup. John Avalos questioned Mayor Ed Lee during the July 15 Board of Supervisors meeting about what needs to happen to move toward divestment. Groups such as Fossil Free SF and 350 SF are asking the same question since the issue of climate change is nearing a critical threshold.

Kimberly Pikul and Jed Holtzman of 350 SF told the Guardian that now is the time for action. “There is only so much carbon that we can release before we cook the planet beyond a level to which we can adapt,” Holtzman told the Guardian.

Pikul and Holtzman explained that carbon reserves owned by publicly traded fossil fuel companies represent five times what would be required to “cook the planet.” Only 20 percent of owned reserves can actually be used without massive environmental consequences, so they say stock in a fossil fuel companies is overvalued, making it a risky investment.

“To protect the long-term financial health of the pension fund and the benefits of city workers and retirees, it is a certainty that SFERS needs to divest from its fossil fuel holdings,” said Holtzman.

Despite the unstable investments and risk of environmental change, Mayor Lee seemed more concerned with jobs and green projects when Avalos questioned him about the Retirement Board’s progress at the Board of Supervisors meeting.

Lee told Avalos: “Our commitment of $4.5 million a year to GoSolarSF will continue to create local green collar jobs and … contribute [to] the creation of locally produced 100 percent green energy. These are the kinds of meaningful investments that actually deploy dollars, create jobs, and move the needle on green energy.”

Despite SF’s support of green jobs, Avalos, Fossil Free UC and 350 SF see divestment as one of the pathways toward long-term environmental change and more sustainable energy projects.

But, as Avalos pointed out, the Retirement Board has “yet to take any steps to divest from fossil fuels or limit the retirement fund’s exposure to the financial risks posed by climate change.”

The only step taken so far is to initiate “Level 1” shareholder engagement with fossil fuel companies. Pikul and Holtzman explained that Level 1 engagement “is largely cosmetic and only calls for SFERS to vote their proxies on climate-related shareholder votes.” The next step is Level 2: shareholder advocacy and engagement with fossil fuel companies. The ideal is Level 3, or investment restriction/divestment.

SF isn’t the only city to seek divestment. Oakland and Berkeley are also pursuing the cause, as are Portland and Seattle. The University of California has also been deliberating the issue and plans to vote on divestment in September.  

But the UC Board of Regents seems skeptical, despite the push from students. UC President Janet Napolitano told the Daily Bruin, “Using divestment as a tool is something that should be done rarely, if at all.”

An open letter from faculty to the UC Regents, posted on Fossil Free UC’s website, bases the argument for divestment on students’ well-being: “Current students will be at the peak of life in 2050, identified by numerous studies as a point at which the global community will have either adequately responded to climate change, or will be suffering horribly from it.”

When Harvard rejected divestment in 2013, University President Drew Faust told the San Francisco Chronicle that she found “a troubling inconsistency in the notion that, as an investor, we should boycott a whole class of companies at the same time that, as individuals and as a community, we are extensively relying on those companies’ products and services for so much of what we do every day.”

Stanford University had a similar dependence issue, which is why it compromised by divesting from coal companies, instead of all fossil fuel companies. Before divestment, the university received $19 billion from coal-related investments, money that will now be invested in other things.

While the partial divestment is a step in the right direction, Fossil Free UC student organizer Silver Hannon said, in a press release following July 16 Regents meeting, “While partial divestment could stigmatize the dirtiest energy source, we need to see the Regents take a real leadership position on the issue by adopting a comprehensive fossil-free investment strategy.”

As for SF, Mayor Lee promises that divestment will happen after the Retirement Board has considered the consequences. Since there doesn’t seem to be a study currently underway, the best course of action is to keep Lee and other officials accountable for SF’s climate and clean energy goals, said Pukil and Holtzman.

Lee seems confident that SFERs will divest, even if the timeline is currently unclear.

“I know the commission does seriously consider the fiscal consequences of divestment, and sometimes they decide the benefits outweigh the costs,” Lee told the supervisors. “I trust the Retirement Board and staff to make the right decisions in this regard.”

Alternative Ink discusses the flurry of SF ballot measures moving through City Hall

Digging deep during the height of summertime fun and frivolity, we Guardianistas showed up in force last night for another lively and informative edition of our biweekly radio show, Alternative Ink, on BFF.fm. With the fall ballot being filled out inside City Hall in recent weeks, we discussed rival housing measures sponsored by Sup. Jane Kim and Mayor Ed Lee, as well as the anti-speculation tax. We also covered the Restore Transportation Balance (placed on the ballot by citizens) and Let’s Elect Our Elected Officials (which was narrowed denied a spot on the ballot by the Board of Supervisors) measures that have been burning up the SFBG comments section lately.  

We talked tech, prompted by our pair of long and insightful stories in last week’s issue, and we previewed an interesting story in our coming issue about how San Francisco is dealing with a flood of young immigrants who have showed up seeking refuge status. As always, the show was peppered with great music, this time with a decidedly international flair thanks for our award-winning Art Director Brooke Ginnard’s return from a three-week vacation in Europe (welcome back, Brooke).

Betty Yee cleared for November runoff after Perez halts Controller’s race recount

California Controller candidate Betty Yee, a San Francisco Democrat, will officially square off against Fresno Mayor Ashley Swearengin, a Republican, in the November runoff election after rival Democrat John Perez today called off a recount request. Perez finished in third place, just 481 votes behind Yee.

Perez, formerly the first openly gay speaker of the California Assembly, had asked for recounts in Kern, Imperial, and San Bernardino counties on July 6. But as those counts dragged on and the deadlines for printing fall ballots neared, the California Democratic Party was pressuring Perez to withdraw, last week contributing $50,000 to her campaign.

The Perez campaign released the following statement just before 5pm today:

“Today I have made the decision to bring the recount process to an end, and pledge my full support to Betty Yee to be California’s next Controller.  

While I strongly believe that completing this process would result in me advancing to the General Election, it is clear that there are significant deficiencies in the process itself which make continuing the recount problematic. Even in the effort so far, we have found uncounted ballots, but there is simply not enough time to see this process through to the end, given the fact that counties must begin printing ballots in the next few weeks in order to ensure that overseas and military voters can receive their ballots in a timely manner. 

I began this process because every vote deserves to be counted fairly and accurately, and as the recount has made clear, California needs to rethink our approach and incorporate best practices from across the nation. This effort was not about the outcome of a particular election, but the integrity of every election, and the issues brought to the light over the last two weeks need to be addressed in a comprehensive and thoughtful manner. 

It has been an honor and a privilege to serve in the Assembly these last six years, and to have led the Assembly at a time when we’ve turned multi-billion dollar deficits into multi-billion dollar reserves, expanded healthcare for more than three million Californians and made college affordable again by enacting the Middle Class Scholarship Act. I am grateful for the support my campaign has received from everyday Californians who have seen the work my colleagues and I have done in the Legislature, and embraced our vision of fiscally responsible and progressive government which expands opportunity for all Californians. We built a tremendous record of accomplishment together, and I look forward to making contributions to build on that record of progress in the future.

In the immediate term, I will be continuing my service in the Assembly, and working hard to help elect Democrats up and down California.”

Housing supply and demand theory on trial at City Hall

The November ballot is shaping into a housing supply theory showdown, and yesterday’s [Thu/17] Board of Supervisors Rules Committee hearing was the first round.

The committee hosted two hearings on rival housing proposals for the November ballot: Sup. Jane Kim’s City Housing Balance Requirement and Mayor Ed Lee’s Build Housing Now initiative. The two purport to set similar goals for building affordable housing, but Lee’s proposal contains a poison pill that would invalidate Kim’s measure. 

The mayor’s philosophy on housing, a strict supply and demand argument, was on full display. 

“[Housing] is a competition based on who has the most dollars in their pocket, and the ones with the most dollars win,” Olson Lee, director of the Mayor’s Office of Housing said at the hearing. “If we limit the supply, the people with the most dollars will win.”

The arguments are a little complicated, but let’s try to break them down: Kim’s initiative lays out a requirement for new construction to build 30 percent affordable housing and 70 percent market-rate housing. Currently, new construction projects can build on-site affordable or pay a fee into a pot, known as the Affordable Housing Trust Fund. If new construction needs to be exempt from the balance requirement, under Kim’s measure, that can be decided by the Planning Commission. 

But the mayor and his deep-pocketed development allies are shrinking away from this like the Wicked Witch of the West from water. Affordable housing doesn’t make a dime for developers, and the mayor fears Kim’s policy will slam the breaks on market-rate housing construction.

Yet Kim’s measure is based on what many progressives in San Francisco believe: San Francisco’s housing market is hot, profits are high, demand is insatiable, and building lots of market rate housing that will never be affordable to most San Francisco won’t solve the city’s affordable housing crisis. The construction pipeline won’t slow down with a few dings to profit margins, she argued. 

“I just have to say if building 30 percent affordable housing will halt development, we’re in a whole lot of trouble,” Kim said to her critics. “We have to build. Even people that make money leave San Francisco every day.”

No one is saying Kim doesn’t believe more housing needs to be built. But Lee’s staffers emphasized a belief that more housing construction alone is the solution to the city’s ills, a strategy that hasn’t exactly netted stellar results recently. They also defended the Affordable Housing Trust Fund, as the Mayor’s Office of Housing is funded about “40 percent” from developer’s fees, Olson Lee said. Sarah Dennis Phillips, from the Mayor’s Office of Economic and Workforce Development, argued sharply that any hit to developer’s fees, even marginal ones, would result in a loss of dollars for the city’s General Fund, the funding pot feeds most city services.

The mayor’s ballot initiative essentially asks for a vote of confidence in his plan to build or rehabilitate 30,000 housing units by 2020, which some in the press have pilloried as depending heavily on already-existing units. While 30,000 sounds like a lot, the Controller’s Office said San Francisco would need as many as 100,000 housing units to even make a dent in San Francisco’s skyrocketing housing prices, according to the SF Examiner (though he has since written the Examiner to say his sentiments were misconstrued). The city’s Civil Grand Jury recently released a scathing report of the mayor’s 30,000 housing unit goal, saying “While the residential real estate market is enjoying a strong recovery, it is doubtful the city can build its way out of the current affordability crisis.”

Meanwhile, people are losing their homes and fleeing the city. Some who are holding on by a thread came out to speak at the dueling hearings. 

“I have health challenges including cerebral palsy,” Justin Bennet said during public comment. He spoke with a difficulty in his jaw, haltingly and with much effort. He said the housing market made it difficult to move from the dangerous areas of the city he calls home. “I’ve been robbed outside several residences I’ve lived in, so I’m hoping for a change in my housing situation in the future. Thanks for letting me speak.” 

A family came up to the podium to speak, with two young housing activists, a brother and sister, 9 and 6, saying they didn’t want to see so many lose their homes.

Advocates from the SEIU 1021, South of Market Community Action Network, Alliance of Californians for Community Empowerment, and the Chinese Progressive Association, to name a few, were on hand at the hearing. They were also on hand for a press conference on the steps of City Hall shortly before the hearing. Ed Donaldson from ACCE called out the mayor’s housing measure, saying its only intent was to torpedo Kim’s. 

“I say we should play chicken with the mayor,” Donaldson said at the podium. Metal bands have sung with less volume than the baritone he used while booming, “Let’s see if he has the gall.”

Inside the hearing, Patrick Valentino (who championed luxury development on the waterfront) and Tim Colen of the Housing Action Coalition spoke, defending the mayor’s measure.

“As San Francisco, as a city in affordability, we’re failing. Our rate of failure is accelerating,” he said flatly. He criticized Kim’s plan and asked, “Where’s the money? No one disagrees we need it. The shortcoming I see in the housing balance measure is its premise that if we increase restrictions on market rate housing, it helps subsidize housing.” 

He argued instead to gather more stakeholders together (i.e. deep pocketed developers) to negotiate more private funding, a strategy he said that worked in the past. 

As others came to the podium to argue against developer greed, Colen watched on, shaking his head, seemingly in disagreement. When someone in public comment argued that developers so far have shirked their responsibilities to build affordable housing, he shook his head again and left the hearing room. 

There’s a stark divide in housing philosophy, and supply and demand’s ability to save San Francisco will soon see a trial by voter if Kim’s charter amendment can win six vote at the full Board of Supervisors. 

The mayor’s policies seem to be more of the same, Kim said, and now the city seems to be fighting over the crumbs of developers’ fees. Despite opposition from the mayor, Kim told the Guardian she’s open to new ideas from the mayor. 

But she also said she won’t back down. 

“We’re on a two-fold path right now. If there’s a compromise to get [the city] to 30 percent affordable housing, like new revenue, we’re open to that compromise,” she said. “But we always intended this to go to the ballot.”

SF bankers now exporting tenant-displacing TIC loans

Fractional mortgage loans used to convert apartments into owner-occupied tenancies-in-common have fed the eviction and displacement crisis in San Francisco, where the median home price just surpassed $1 million for the first time. Now, some of the same San Francisco banks that pioneered fractional loans here have started offered them in the East Bay and on the Peninsula.

TIC housing is an ownership model for multi-unit buildings, where each unit is independently owned. This option appeals to would-be homeowners because it’s cheaper than a condominium, but less fraught than a traditional loan shared by various owners in a TIC building, which does not allow for independent ownership of each unit.

TICs local have grown in popularity in San Francisco as housing prices continue to skyrocket, since they help homeowners find something affordable, although that benefit usually comes at the cost of evicting all the tenants in the building, often including seniors, those with disabilities, and low-income people in rent-controlled units.

Previously, fractional TIC loans were only accessible in SF. Now, as people seek affordable housing outside of expensive San Francisco, the demand for fractional TIC loans has grown. And San Francisco bankers have stepped up to meet that demand, according to a recent article in the San Francisco Business Times (“High-priced SF housing market exports fractional tenants-in-common loans,” June 28).

Sterling Bank & Trust has become well-known for providing fractional TIC loans (more than $480 million worth so far, according to the Business Times), and is the first company to offer the loans outside of San Francisco. “We’re helping the firefighter and school teacher, or what I like to call the ‘non-tech’ buyer, purchase a home,” Stephen Adams, senior vice president of Sterling Bank & Trust, told the Business Times.

Adams is also president of the San Francisco Small Business Commission, presiding over what critics say is a shift in that commission toward rubber-stamping initiatives from the Mayor’s Office rather than defending small business interests. When we contacted Adams to ask about the evictions and displacement caused by fractional loans, he told he had “no comment to make at this time.”

Tommi Avicolli Mecca, the director of counseling programs at the Housing Rights Committee of San Francisco, said that he doesn’t know how the TIC loans might affect those in the East Bay. But he does know they’re bad news for San Francisco, where there’s now a 10-year moratorium on new condo conversions but few controls on the creation of new TICs.

“They’re scary,” Avicolli Mecca told us. “It’s a disaster for San Francisco. Basically, if you’re buying a tenancy in common, you don’t need to condo convert. It used to be that you wanted a condo conversion so you could have a separate mortgage on what you own. With a fractional loan, you have your own mortgage from the start.”

He added that the loans make it easier for sellers to convert buildings into any size that they can market to home buyers. With the loans, combined with the state Ellis Act allowing owners to remove apartments from the rental market, evicting tenants becomes even more profitable.

The Bank of San Francisco confirmed that it also offers TIC loans in the East Bay. The bank will be making them more attractive with interest-only payments, fractional financing for buildings with more than 12 units, and loans up to $2 million.

Dylan Desai, a spokesman for the Bank of San Francisco, told us that the bankers “do not extend financing to buildings where there has been an eviction” and, to their knowledge, they never have. “We’re sensitive to tenant rights.”

Hopefully the other banks offering these loans will be just as sensitive as they branch out into communities in the region that have already been absorbing an influx of working class former San Franciscans.

More funding promised to Central American child refugees, Lee warns of new influx

Thousands of Central American children fleeing drug wars and poverty are overwhelming the San Francisco nonprofits who care for them, but new information from the mayor shows this may just be the beginning.

Yesterday, just hours before Supervisor David Campos’ resolution to bolster funding to aid the incoming refugees passed, Mayor Ed Lee warned the Guardian and other journalists that San Francisco is bracing for another influx of even more children in need.

“I met with the federal Health Service System to prepare our city for the possibility of a higher influx [of refugees],” he said. “The numbers seem to be coming in, though they haven’t reached us yet.”

Campos’ measure to focus funding on the needs of Central American child refugees passed by unanimous vote, likely because its sorely needed. Nonprofits in San Francisco like the Central American Resource Center (CARECEN) and other sounded the alarm: there are too many refugees, and not enough caregivers and legal aid to help them. More than 36,000 Central American children (often unaccompanied) entered the US illegally between Oct. 2013 and May this year, according to widely reported federal data. The number of Mexican children entering the US dropped to about 17,000. 

But why are they coming here? Many reasons, but mostly they’re fleeing violence. Honduras, for instance, was the murder capital of the world, with 79 people murdered in every 100,000, according to Reuters. Neighboring El Salvador didn’t do much better, with the second highest murder rate per capita in the world. 

“I am from Honduras and I just turned 16-years-old,” a teenager named Juan said, in a statement from CARECEN, “I came after my father was murdered and I feared for my life that I was next. If I go back I’m not sure that I can go back and live a good life. I want to go to school and live so I can grow up to do something good.”

False rumors in Central America that the US is offering permisos, meaning, permanent status, also spurred an influx of refugees. 

CARECEN’s Washington D.C., Los Angeles and San Francisco locations are advocating for President Barack Obama to declare a state of emergency and aid these refugees. But as the federal government grasps at possible solutions, local government is stepping in to help those reaching the city. 

“There’s a long history on this board on calling out against injustices we’ve seen in different parts of the world,” Campos said at the board yesterday as he introduced his measure, adding “They’re escaping not just political turmoil but violence in their lives.”

“These are children,” he said. 

Lee said one of the biggest challenges in helping these children may be a cultural one.

“I’m trying to wrap my arms around the fact that many of these kids don’t speak Spanish,” Lee told the Guardian yesterday. “They speak Mayan and different languages. This will test our cultural competency.”

Campos is planning a hearing on how best to focus funding to aid the child refugees, but hasn’t yet settled on a date for said hearing. 

“Let’s Elect Our Elected Officials” rejected at the Board of Supes

At today’s (Tue/15) Board of Supervisors’ meeting, members of the board voted 6-5 against placing a proposal on the November ballot that would create special elections when vacancies arise on the Board or in the Mayor’s Office.

If approved by voters, the measure would have immediate impacts on San Francisco’s political landscape. Board President David Chiu is vying for a seat in the California Assembly against Sup. David Campos, which will leave a vacancy on the board one way or another. 

But Sup. John Avalos, who authored the charter amendment proposal, noted that “this measure is not about any existing mayor or any existing supervisor.” Instead, Avalos described the measure as a bid to make city policy more democratic. 

“It will allow voters to decide who fills vacancies in special elections,” Avalos said.

As things stand, when a supervisor’s seat is vacated, it’s up to the mayor to appoint that official’s replacement. When a mayor’s seat is vacated, a much more rare occurrence, it’s up to “a small minority of people – us,” to appoint the city’s top elected official, Avalos said. “This shapes how decisions are made, often behind closed doors.”

Taking this question to voters via special election would ultimately be more democratic, he added. “If you are on the fence on this measure, I hope you can still send this ballot measure over to the voters,” Avalos told his colleagues.

Sups. London Breed, Katy Tang, and Scott Wiener each spoke in opposition to the idea.

“It’s not a perfect system, but no system ever is,” Breed said. “I’m not sure what problem we’re trying to solve with changing the charter.”

Wiener sounded a similar note. “There are various ways you can do it, and no way is necessarily better or worse,” he said of the current system for appointing vacancies. “I don’t see how the system that we have is in any way broken.”

But Sup. David Campos chimed in to challenge that framing. “The question before this board is not, what is the best system? … The question is a lot simpler than that,” Campos said, “Since we are talking about democracy. The question is: Will we give voters in SF the opportunity to decide for themselves what the best system is? Let’s not you and I pre-judge what the voters are going to say.”

In the end the measure failed six to five, with Sups. Mar, Avalos, Campos, Chiu, and Jane Kim voting in favor.

Why I drive a taxi

OPINION I left a 17-year career in film to become a taxi driver. I just wanted to be here full time, drive a taxi, and write.

I’ve taken cabs in several cities and countries over the last 20-odd years. When I got here in 1998, it took two hours for a taxi to get to my house on 43rd Avenue. I still never would’ve gotten into anyone’s personal car and paid them for a ride, no matter how hard it was to get a cab sometimes. Not in San Francisco. Not in Jamaica. Not in Jamaica, Queens.

I’m from Toledo, Ohio originally. We always went on road trips. Maybe being in such close proximity to Detroit, some of that car mojo rubbed off on us. My mother is the kind of woman who, at 70 years old, will drive cross-country alone, stopping to call me at 3am from deserted truck stops outside Amarillo, Texas. You might see why I’d drive a taxi.

I have a feeling that a lot of the anti-taxi contingent now in this city haven’t taken too many cabs. Cabs could never put me off because I’d taken so many of them and I knew I was safer in one than standing in a crosswalk. I’ve been hit by cars on foot and on my bike but I’ve never been in an accident in a cab. Not in London. Not in Los Angeles. Not here.

I don’t drive for Lyft or Uber because San Francisco cab drivers receive workers compensation and TNC drivers don’t. Because Lyft mustaches look unprofessional to me. I went to taxi school, got fingerprinted, had a background check, and got licensed.

My taxi has 24/7 commercial livery insurance. My company pays the bills if there’s an accident. San Francisco taxi companies don’t have bylaws stating that passengers cannot hold them liable. San Francisco taxi companies don’t have bylaws stating that passengers take taxis at their own risk. San Francisco taxi companies don’t have bylaws that can be legally interpreted to allow discrimination against passengers of any persuasion. We have to accept pets. And we have to be green.

San Francisco taxis pick up bartenders, sweet old ladies at the hospital who don’t have smart phones, teachers, lawyers, wheelchair users, people of color, San Francisco Giants, former mayor Willie Brown, hookers, trannies, ballerinas, and limo drivers. Everybody. You don’t need a smartphone, but you can always hail a cab using an app called Flywheel.

I’m not a fan of the smugness emanating from Lyft, Uber, et all. Perpetuating spurious claims that cab drivers are all scary or awful is neither cute nor clever. And it certainly isn’t true.

It’s far more likely for a passenger to physically attack a cab driver than the opposite. About a month ago, several men took a cab from my fleet to San Mateo and severely beat up the driver. We have video cameras in every single San Francisco cab, but that still didn’t guarantee this driver’s safety. Nonetheless crime and accidents in taxis are down significantly.

We’re mothers, fathers, grandparents, students, artists, musicians, and entrepreneurs. Cab drivers give companionship, counseling, and safe passage to their passengers.

I want to know how we can have faith in TNCs when drivers aren’t commercially licensed, fully insured, and packing security cameras. How should we feel about droves of these Uber and Lyft phones being shared by multiple drivers, when only one is on record? What happens when a TNC is wrapped around a pole and the driver is held responsibility for their own safety and well-being. These brand new cars won’t be paid off before we start to witness incidents such as this.

How’s a “young mother just trying to make some extra pocket money” going to feel when she has her wages garnished into perpetuity because she rear-ended someone? She’s personally liable with the TNC company. She’s your friend with a car who absorbs all legal responsibility whether she’s found at-fault or not.

As long as there’s a taxi industry, I’ll keep proudly driving my taxi in the city I love. I’ll pick up sweet and not so sweet old ladies, people in wheelchairs, people with dogs, and whomever else needs a ride wherever it is they need to go.

Supes to vote on Avalos’ “Let’s Elect Our Elected Officials” measure

The San Francisco Board of Supervisors will vote tomorrow (Tue/15) on whether to submit a charter amendment to the ballot that would require a special election in the event of a vacancy on the Board of Supervisors or in the mayor’s office.

As things stand, the mayor holds the power to appoint someone to fill a vacant seat on the board. But Sup. John Avalos’ proposed ballot measure, unofficially dubbed “Let’s Elect our Elected Officials,” would shift that decision-making power to the voters. The measure needs six votes to pass.

If it wins voter approval, the measure would also likely have a significant impact on the city’s political landscape in the immediate future.

Sup. David Campos, who is co-sponsoring the initiative, is currently vying for a seat in the 17th Assembly District against Board President David Chiu, a narrow race that will leave a vacancy on the Board one way or another. If Campos, one of the board’s most progressive members, is elected, Mayor Ed Lee would presumably appoint someone to his seat with a rather different political bent.

The ballot needs an additional three votes (beyond its three sponsors) to reach the necessary six votes necessary for approval by the Board, and “it’s sort of up in the air at the moment,” according to Jeremy Pollock, Avalos’ legislative aide.

Some supervisors are reluctant to go against Lee by limiting mayoral power. Opposition from Sup. Katy Tang, herself a beneficiary of the current rules when she was appointed by Mayor Lee in February 2013, has also had an effect of the amendment’s approval.

But supporters of the bill are hoping the overall benefits of the measure will lead the supervisors to approve it.

“John sees this as a good government reform that takes some power away from the mayor and the Board and gives it to the voters,” Pollock said, with the hope that it would also work to discourage backroom deals.

Another potential issue raised over the approval of the measure is the cost of special elections, though it appears to be a relatively minor concern. According to the San Francisco Department of Elections, a special election for supervisors costs roughly $300,000 (a drop in the ocean given the city’s multi-billion dollar budget) and around $3.5 million for a citywide election, a substantial sum but also a relatively minor worry given the rarity of vacancies in the mayor’s office. Some might argue that given the importance of the mayor’s duties, that’s a small price to pay to allow the voters to have a say.

In addition to its main rule change, the measure includes a few other provisions, such as making an exception for the proposed rule if a regularly scheduled election would be held within 180 days of the vacancy.

It would also provide “that the Mayor appoints an interim Supervisor to fill a supervisorial vacancy until an election is held to fill that vacancy,” with the key addition that the interim supervisor would be ineligible to compete in that election.

That’s no small stipulation, given the sweeping historic success of incumbents in board re-elections. (Since 2000, when district elections returned, Christina Olague is the only incumbent who failed to gain re-election after being appointed.) Avalos appears set on plugging all holes with his proposed legislation, and it’s now up to the board to place it on the November ballot.

City will turn Francisco Reservoir into a park, with no affordable housing

San Francisco is getting a new park – but the deal has left some wondering why a small portion of the new parkland couldn’t have been set aside to build housing for teachers and firefighters.

On July 8 members of the San Francisco Public Utilities Commission voted unanimously, amid a flurry of congratulatory exchanges, to transfer the Francisco Reservoir to the Recreation and Parks Department. Nearly everyone who weighed in during public comment praised the decision to convert the reservoir site into open space for the surrounding neighborhood. Located near Russian Hill on Hyde Street just above Bay Street, the Francisco Reservoir has gone unused for the better part of century.

One speaker did offer some balance. “We have the mayor and the Board of Supervisors constantly hitting us over the head saying we need housing,” she pointed out. “We have to start somewhere.” 

Under city law, publicly owned “surplus property” – as the Francisco Reservoir is categorized – must be considered for affordable housing before city departments may let it go for any other use.

Yet during years of discussion between neighbors and city officials to discuss this 4-acre parcel, the idea of building affordable housing apparently didn’t even receive minimal consideration.

Instead, the affluent neighbors wanted a park – and managed to raise nearly $10 million in private funding through several neighborhood associations to help make it happen. That money has been pledged for a park endowment, to cover development and maintenance purposes.

According to City Attorney spokesperson Matt Dorsey, the city’s “enterprise agencies” are exempted from the affordable housing requirement in the surplus property ordinance – this applies to surplus parcels under the ownership of the Port, the SFPUC, the SFMTA, and the Recreation & Parks Department.

A memorandum of understanding approved by the SFPUC, which must win the approval of the Board of Supervisors and the mayor before being finalized, grants some $10 million from the Recreation and Park Department’s open space fund to purchase the Francisco Reservoir from the SFPUC.

Open space is generally a wonderful amenity in an urban environment, particularly for land that hasn’t been used in decades. As Jan Blum noted at the hearing, the parkland will provide environmental benefits such as “habitat for migratory birds, as well as local wildlife.”

But the city’s decision to convert surplus property to open space comes just as Mayor Ed Lee is seeking to build 30,000 new housing units to stem the affordability crisis.

John Stewart, a prominent affordable housing developer appointed to serve on Lee’s affordable housing task force, told the Guardian that he got nowhere when proposing the idea of affordable housing construction for a small portion of the Francisco Reservoir parcel.

Stewart, who emphasized to the Bay Guardian that his company has no financial ties nor interest in developing a project there, penned an editorial for the San Francisco Business Times earlier this year on the Francisco Reservoir transfer, asking, “Why not expand the conversation to include the subject of housing?”

The idea was not well received. “I did not even propose tax-credit, tax-driven, very low income housing,” Stewart noted. “I proposed moderate-income, for teachers and nurses.”

The neighborhood plan showed the area at the end of the parcel, where Stewart thought housing could go, as a dog run.

Sup. Mark Farrell, who represents District 2, where Francisco Park would be located, was deeply involved in discussions about converting the reservior into a park. Farrell’s office didn’t return calls seeking comment, nor did the SFPUC.

“Sup. Farrell didn’t want me speaking to these groups,” Stewart said. “Nobody said, come by, come to our coffee klatch, make the case and we’ll at least talk it over. Nobody wanted to discuss it – that was clear. There was polite silence. But there was silence,” he said. “And their view is – and it’s understandable – they really want to have the whole thing.”
