Mayor Gavin Newsom’s 2008 inaugural address under City Hall’s caverous domed rotunda looked like a rehearsal for his upcoming wedding to actress Jennifer Siebel, what with the choir trilling, the reverend pronouncing his blessings, the family Bible, the bucket loads of roses, and Newsom’s sister’s cute little kids running all around.

Less adorable was the fact that Newsom’s speech contained a not so thinly veiled attack on the November 2008 charter amendment, which seeks to set aside $2.7 billion in city funds for affordable housing over 15 years.

The amendment would give affordable housing the same baseline of funding that the city already allocates to the Recreation and Park Department Fund and the Library Preservation Fund—and less than it already sets aside for the Children, Youth and Families Fund.

Sounds reasonable to those of us who have no hope of owing a home in San Francisco and are either having difficulty cobbling together the rent each month for our lowly studio/room/apartment/shack in the City, or are already displaced to the East Bay.

It’s a point that a super majority of the Board of Supervisors, along with State Senators Carole Migden and Leland Yee, and Assemblymembers Mark Leno and Fiona Ma, all seem to get, given their support for the affordable housing set aside.
But not, apparently, Newsom, who smeared this amendment as “a political gambit,” while pushing a Lennar-backed measure that promises to build 10,000 housing units at Candlestick Point, but does not specify what percentage of these units would be below market rate, for rent, or affordable, to people who currently live in the Bayview.

“In the next four years we are going to keep offering real solutions on affordable housing, not fall prey to political gambits that offer attractive promises but not sound policy,” Newsom said, during his address.

But is the newly resworn-in Mayor’s resistance to the Board’s affordable housing charter amendment rooted in the fact that it would require the Mayor’s Office of Housing to prepare an affordable housing plan every three years, present an annual affordable housing budget and do so before the rest of the Mayor’s annual budget proposals are finalized?

All these steps are crucial, in terms of transparency, accountability–and ensuring that the affordable housing needs of low-income and working class folks get top priority, instead of becoming an annual political football. They are also logical steps, for those seeking sustainable solutions to homelessness and climate change, as Newsom claims to be doing.

But instead, Newsom continues to lend his support to the Lennar-backed measure on the June 2008 ballot, even though Lennar broke its promise to build rentals at its Hunters Point Shipyard Parcel A site, where it is constructing 1,500 condominiums, and failed to live up to its promise to proactively protect local residents from asbestos dust.

Let’s Newsom sees the light, uses his political capital to support the affordable housing charter amendment, and thus lives up to his promise to protect all of the City’s residents, for the next four years.

Lantos, Speier, Yee: The mad rush is on

I’m sorry to hear that Rep. Tom Lantos has cancer, and I wish him well. But I’m very glad he’s leaving Congress; he was bad on the war and has been a foreigh-policy hawk for many years.

And now comes the scramble.

This is the first time since 1986 that a house seat has opened up in San Francisco. It’s a chance that comes along once in a lifetime for many politicians, and since it’s a safe Democratic district, whoever wins the primary in June will be almost guaranteed a seat in Congress for life.

Jackie Speier has already announced, and was prepared to take on Lantos. She instantly becomes the front runner. But I would be shocked if state Sen. Leland Yee didn’t jump in to the race, and I suspect there will be a few others joining the mad scramble.

There’s no obvious prominent progressive in the district, but let’s not write this one off yet.

Campaign sewer overflows

The flow of election cash is often a filthy river that you wouldn’t want to drink from, and a recent local lawsuit, coupled with a new bit of state legislation, has muddied the waters even more.

On Sept. 20, US District Court Judge Jeffery S. White granted a preliminary injunction preventing the city from enforcing key sections of its Campaign Finance Reform Ordinance.

Two local groups with a sordid history of influencing elections with large chunks of cash — the Building Owners and Managers Association and the Committee on Jobs — argued in court that campaign contribution limits violate the First Amendment by financially curbing the ability to communicate a message (see "Pressing the Scales," 8/22/07). The contribution limits of independent-expenditure committees stumping for candidates were set by the voter-passed Proposition O in 2000 after the 1999 reelection of Mayor Willie Brown, in which deep-pocketed business interests backed the mayor in exchange for preferential treatment by city hall.

Prop. O capped contributions to IEs at $500, and people and corporations are allowed to give no more than $3,000 total (e.g., $500 each to six committees).

Those caps are no longer enforceable.

Similar injunctions have been granted in San Jose and Oakland, also destroying local contribution caps in those cities. San Jose appealed to the 9th Circuit Court of Appeals and is waiting for a ruling. Ann O’Leary, a lawyer in City Attorney Dennis Herrera’s office, told us San Francisco is waiting to see what happens in San Jose before making the next move, though an appeal is planned regardless of that outcome. In the past the Supreme Court has ruled that the appearance of corruption in elections is sufficient grounds for restricting campaign contributions, and San Francisco’s history provides ample examples from which to draw to support that decision.

"We don’t know if it will get back to court before November 2008," O’Leary said of the case, "but it’s certainly something to watch in that election."

Meanwhile, over in Sacramento, legislators on cruise control recently passed a bill that may make it impossible for San Francisco to write its election laws anyway. Gov. Arnold Schwarzenegger just signed Assembly Bill 1430, and according to the legislative digest, the new law "prohibits local governments from adopting campaign finance ordinances that restrict communications between an organization and its members unless state law similarly restricts such communications, or by regulation by the Fair Political Practices Commission."

Proponents say the new law will resolve conflicting interpretations of campaign finance regulations, but opponents say it preserves wide-open loopholes in the Political Reform Act that local jurisdictions have tried to close. For example, a person may be prohibited by the city from giving more than $500 to support a certain candidate. That person can, however, give as much as $30,200 to the Democratic Party, which can then "communicate" a message of support for that candidate to its members.

A recent and egregious example: in San Diego the county Republican Party spent almost $1 million on local races in 2006.

The bill was authored by Carlsbad Republican Martin Garrick and flew through the State Assembly unopposed. Assemblymember Mark Leno told us it came to the Elections Committee, on which he sits, with no vocal opposition, so he gave it an aye. One of his aides, however, became concerned and started making calls. Eventually, Common Cause and the League of Women Voters rallied against it, but it only hit a speed bump in the State Senate. There was still too much support from the Democrats to kill it. Leno said, "It’s an uncommon situation to have the left and right supporting something that in fact runs counter to local election laws."

Only nine senators opposed the bill, including Carole Migden and Leland Yee. "She thought it was an end around campaign finance laws," Migden aide Eric Potashner told us.

San Francisco’s Ethics Commission also took a look at the bill and gave it a 5–0 thumbs-down, resolving to send a letter to both the mayor and the Board of Supervisors urging them to speak against it. Neither did. "The Mayor supports AB1430," his press secretary, Nathan Ballard, told us by e-mail. "He has some concerns about the local control issue, but ultimately those concerns are overridden by his belief that groups like labor unions and the Democratic Party should be allowed to communicate directly with their members."

The governor’s signature now makes it more difficult to pass future measures like Prop O.

Neither the injunction nor the new law seems to be affecting the Nov. 6 election — the FPPC won’t be ruling on AB 1430 until January, though the commission is holding a hearing for interested people to speak in Sacramento on Nov. 2.

Though BOMA and the Committee on Jobs stated in their filing for the injunction that the law harms their ability to raise and spend money for candidates in this November’s election, nothing on record with the Ethics Commission shows they’ve been putting up a lot of money for Newsom, Kamala Harris, or Michael Hennessey. But there’s always next year.

Leno, Migden and Sacramento madness

Migden, Leno: Who’s killing the bills?

It’s been a wild few days in Sacramento.

On Thursday afternoon, the state Senate narrowly passed a terrible campaign finance bill that could strictly limit the ability of local governments to control political money. Although Common Cause and the League of Women Voters opposed it (as did San Francisco’s Ethics Commission director, John St. Croix) it had the support of the Democratic Party and had sailed through the Assembly, 77-0. On the Senate floor, Carole Midgen and Sheila Keuhl both made strong speeches against it – and almost, almost convinced enough of their colleagues to vote it down. Instead, it squeaked through 27-9 (needing two-thirds).

Migden at least tried. Good for her. Leland Yee voted the right way. But the arm-twisting by the party was too much.

And frankly, the opponents of the bill weren’t exactly on their game: There was no opposition when the bill went through the Assembly, and when it came to the Senate floor, the good guys were noticably absent.

Meanwhile, Randy Shaw reports on BeyondChron that Migden is making sure some of Assemblymember Mark Leno’s key bills never get a vote on the Senate floor. The reason: Migden (and her ally, state Senate President Don Perata) don’t want Leno to have any legislative success to brag about next spring when he challenges Migden in the Democratic primary.

See, one of Migden’s central arguments is that she’s an effective legislator. Sure, she cuts deals, she compromises – but in the end, she gets things done. And pointing out that none of Leno’s bills for 2007 actually became law would be a powerful campaign theme.

Among the Leno bills held hostage: A measure that would limit toxic chemicals in household furniture (AB 709) and AB 1590, which would allow San Franciscans to vote to raise local car taxes to provide revenue for city services.

Migden’s office insists that Shaw has it wrong: Tracy Fairchild, communications director, told me: “The root cause of Assemblyman Leno’s problems lies not with Senator Migden but rather with the entire Senate, whose bills met with unusually harsh treatment last week in the Assembly Appropriations Committee which he chairs. Rather than tell that truth, Mr. Leno has chosen to disparage Sen. Migden’s reputation by blaming all his problems on her and that is simply not the case.”

But Leno has another take: “Eight of the nine bills by Carole Migden that came to my committee [Appropriations] made it out, and I will make sure that every one of her Senate bills will leave the Assembly floor.” Only five of Leno’s 13 bills went forward, even though the ones that were bottled up had little real opposition.
The one Midgen bill that Leno didn’t let out of committee, interestingly, was SB 11, which would have extended domestic partnership rights to unmarried opposite-sex couples. Leno says the $33 million price tag doomed it, but I think the real problem was that, while I supported the bill and think it’s a fine idea, there wasn’t any real visible upwelling of support for it.

Overall, the Assembly Appropriations Committee let 74 percent of Senate bills out; only 63 percent of Assembly bills made it out of the corresponding Senate committee.

Part of what’s going on here may be the natural tension between the houses, but I think that Perata is sending a message to Leno and his colleagues: Don’t you dare take on an incumbent senator, or your bills will be held hostage.

I suspect that if Migden doesn’t like this message (and she shouldn’t) she could tell Perata to back off, and Leno’s bills would move forward.

Gutting campaign reform

EDITORIAL A bill that could gut many local campaign finance laws is zipping through the legislature with the support of both the Republican and Democratic parties — and only a few activists seem to be paying attention. We’ve written about the bill, AB 1430 by Assemblymember Martin Garrick (R–San Diego), on the politics blog at www.sfbg.com. It has already cleared the State Assembly, 77–0, and is headed to the State Senate floor, where only one member — Carole Migden of San Francisco — has come out in opposition.

The Republicans and the Democrats love this bill because it would allow their parties to use unlimited amounts of money to support local candidates. That’s become increasingly common in this state; when cities set strict limits on contributions to political candidates, the candidates simply ask their big-money backers to give the money to the state Republican or Democratic Party — which then funnels the laundered, uncontrolled, and often unreported cash into local campaigns.

In fact, the bill comes from the San Diego GOP, which is angry that the San Diego Ethics Commission tried to crack down on nearly a million dollars in unregulated money that went to local races last year.

The bill talks about "membership communications" — as if the parties were simple nonprofits that wanted to send newsletters to their members. That’s not what’s going on at all, and everyone with any sense knows it. Here’s the real story: while the federal and state governments have refused to do any real campaign finance reform, cities and counties all over California have tried to fill the gap. The San Francisco Ethics Commission — for all of its obviously failings (see "Whose Ethics?," 7/11/07) — has the authority and the mandate to regulate local campaigns far more tightly than the state’s Fair Political Practices Commission. So the big donors, working through the state parties, are trying to figure out ways to circumvent local rules.

The conservatives in the State Legislature love to talk about local control when it comes to workplace regulations, environmental protection, and schools — but when a bill like this comes along and threatens to eviscerate local control, they utter not a peep. Nor, for the most part, do the liberals, who are aligned with the Democratic Party and don’t want to defy its mandates.

The San Francisco Ethics Commission has asked Mayor Gavin Newsom and the supervisors to oppose this bill, but the board has taken no action, and the mayor says he actually supports the bill. That’s a disgrace: at the very least, the supervisors should pass a resolution opposing AB 1430 and force the mayor to veto it.

Migden, after talking to the folks at California Common Cause, the public interest campaign organization, took a bold stand against the measure, and she deserves tremendous credit for that. Now the rest of the senate — starting with Leland Yee of San Francisco and President Pro Tem Don Perata of Oakland — needs to go along and kill this monster. *

Who’s following the money?

David Duer is proud of the volunteer work he’s done with the West Contra Costa Unified School District. He graduated from the area’s school system, as did his kids.

So despite what was sure to be a burdensome responsibility with no pay, Duer, a development director for the UC Berkeley Library, accepted the chance to serve on a committee formed under a state mandate to monitor how the district spent $850 million in bond money authorized by voters in three elections since 2000.

"There are schools all over the district that have been renovated," Duer beams today.

The committee initially proposed meeting every quarter but soon realized that wouldn’t be nearly enough to do the job right and chose to meet monthly instead. Since 2003 it has received full-blown management audits of the school system’s performance every year, with biannual updates from independent professionals not beholden to district bureaucrats.

The story of San Francisco’s Community College District could not be more different.

The oversight committee that’s charged with monitoring $560 million in bond spending has never seen an expansive performance audit, just basic financial reports that show community college officials here seem to be obeying their most fundamental fiduciary duties. The panel meets three times a year for more than an hour and a half each time, and for three years it didn’t even report to the public on City College’s handling of the money, which it’s required to do annually by the state’s Education Code.

The community college committee is hardly made of Rotary volunteers and bored retirees: the list includes San Francisco treasurer José Cisneros and former San Francisco Chronicle publisher Steve Falk, now head of the local Chamber of Commerce.

But even members say the panel has fallen down on the job — and that City College officials are freely shifting around the taxpayers’ cash with little or no accountability.

The mostly decipherable performance reports that West Contra Costa citizens receive, though lengthy, track all of that district’s bond expenditures and give the area’s oversight committee of taxpayers a vivid portrait of how well the school system and its administrators are managing hundreds of millions of dollars in building improvements. Any wonkish jargon in the reports that might mystify the committee is translated in "frank" terms by the outside inspectors, Duer says, without interference from school officials.

If a contractor were to double-bill the district or demand too much in change orders after promising completion within a set price range, Duer and his colleagues would know about it, and they could make suggestions on how to fix it. If the district was doing a stellar job, that would be clear too.

"I don’t see these performance audits as punitive," Duer said. "I see them as a confirmation that the process and systems in place are working."

MORE MONEY PROBLEMS


The Guardian reported last week ("The City College Shell Game," 7/4/07) that City College’s bond projects are running an astounding $225 million over budget. As a result, school officials have returned to the Board of Trustees five times in recent years to request that a total of $130 million be reallocated from one project to another to cover the overruns, leaving some projects promised to voters with little or no funding at all. We reported on a number of examples last week, but there are plenty more:

<\!s> The construction of a new Mission campus was supposed to begin in 2002 but didn’t get under way until well into 2005. The project is now $30 million over budget, an increase of 50 percent, and the school recently requested another $6 million diversion from other bond projects. City College originally planned to build the campus where a shuttered theater currently stands on Mission Street but later moved the site to avoid a showdown with preservationists.

<\!s> Since 1997, City College has asked voters for a total of $61 million to renovate and remodel existing buildings and meet Americans with Disabilities Act requirements. In November 2005 it asked voters for $35 million to perform such work, but just weeks after the election, $20 million of the money was reallocated to a planned Chinatown–<\d>North Beach campus that’s now running $50 million over budget, an increase of 60 percent. That project’s ever-changing design has been heatedly challenged by everyone from the Chronicle‘s editorial board to Sup. Aaron Peskin to state senator Leland Yee.

<\!s> Two projects for which voters authorized a combined $71 million won’t see the light of day unless the college returns to the ballot a fourth time, which school officials have discussed. The projects — a biotech learning center and a one-stop administrative shop for new students — have been drained of $42 million to save the Mission campus and an overdue Performing Arts Center, which will cost $75 million more than expected, an increase of 152 percent.

HUNTING AND PECKING


All of this irks Mara Kopp, who was appointed to City College’s oversight committee in late 2005 as a representative of the San Francisco Taxpayers Association. She’s complained openly that the school long ago should have hired auditors for the kind of far-reaching work West Contra Costa gets.

"If we received ongoing management reports, then we’d have something of substance," Kopp said. "We wouldn’t have to hunt and peck in a kind of naive, elementary way."

She is all but alone in her criticism, however, save for a small group of allies including former committee member John Rizzo and Milton Marks, one of the few voices on the independently elected Board of Trustees willing to apply tough scrutiny to Chancellor Phil Day’s office at board meetings. Green Party pol Rizzo recently became a trustee after closely beating longtime incumbent Johnnie Carter in the November 2006 board race.

Day has long argued that the school’s attorneys don’t believe such audits are required under Proposition 39, a 2000 state ballot measure that lowered the threshold for passing local school bonds. Prop. 39 required the formation of local citizens’ bond oversight committees.

Marks has questioned the strength of City College’s oversight committee and the lack of performance audits since at least 2005, but not until earlier this year were he and Rizzo able to force a resolution demanding the inspections, and now Day claims to welcome a management review. The school will bid out its first audit soon.

"The bottom line is, a performance audit as opposed to a financial audit would determine whether or not funds are being expended in the most efficient, effective, and economical manner instead of just adding up these funds and saying, ‘Here’s how much we expended and for what,’<\!s>" said Harvey Rose, a respected local auditor who’s reviewed city agencies and analyzed San Francisco’s annual budget for 35 years.

West Contra Costa concluded that Prop. 39 does require extensive managements audits. The committee even decided to include a $150 million bond election in 2000 in the scope of its work, although that wasn’t required, to ensure all the money was still being spent efficiently.

Duer said it doesn’t matter to him what the letter of the law requires. "It was always assumed with our work that this is something we had to have," he said.

The Los Angeles Community College District made the same assumption. Other districts statewide, however, appear to have interpreted Prop. 39 the same way City College has. And the Attorney General’s Office has never issued an opinion clarifying the matter.

Meanwhile, City College officials blame the millions of dollars in outsize project costs on inflation, a globally increased demand for steel and concrete, and slow-moving state regulators who must approve architectural designs.

"I understand both the college as well as the community would like to see us complete every single project we’ve proposed," Vice Chancellor Peter Goldstein told us recently. "We absolutely share that desire. The reality of cost increases has forced us to go back and look at our resources and reallocate in order to keep major projects going forward."

But Kopp and company argue that much earlier performance inspections would have revealed to the oversight committee and trustees where the increase in expenses came from with absolute certainty. That way, no one would have to rely exclusively on the glitzy project presentations made by Day and Goldstein that are often little more than slide shows with quotes from prominent business journals decrying the rising cost of construction materials. Trustee Marks has moaned repeatedly at board meetings that he doesn’t feel informed enough to vote on major reallocations, and his constant questions haven’t always made him popular.

"I think there’s this feeling that the board should not be adversarial," Marks said. "But I think by the nature of how things are set up, we have to be…. We have to look out for the best interests of the public at large."

Not everything’s rosy in West Contra Costa, of course. Anton Jungherr, a former San Francisco Unified School District official, sat on the West Contra Costa oversight committee for four years and fumed in an interview that the district didn’t take seriously the committee’s regular recommendations. He wants to form a statewide association of oversight committees to arm citizens with the information they need to track bond expenditures.

"There are legitimate reasons for change orders, but you have to analyze them and understand what the reasons are and then take the appropriate oversight action," Jungherr said.

But cost overruns in West Contra Costa still pale when compared with those at City College. Jungherr said that district has experienced about $100 million in unexpected costs on $850 million in projects undertaken since 2000, substantially less than what City College faces despite hundreds of millions of dollars more in bond projects.

Kopp still hopes City College’s oversight committee will build more muscle.

"If they were to show us documents they used themselves in monitoring all these things, that could substitute as long as the information was relevant and honest," Kopp said. "But it’s really been quite shallow all along."<\!s>*

Who paid for Migden’s billboards?

There’s been a fair amount of flap over the big billboards featuring Carole Migden that appeared all over the Third Senate District around Pride weekend. The messages — describing Miden as a leader and thanking her for her work — don’t include any statements identifying the donor who paid for them. That’s led some to suggest that it’s a clandestine gift from Clear Channel, which owns the billboards.

But according to Michael Colbruno, a former Migden aide and close ally who now works for Clear Channel, there’s another explanation:

The billboards, he told me, are “issue advocacy” ads — which means they’re not regulated by campaign-finance disclosure laws. They were purchased, he said, by an individual or entity that is not a campaign committee — and Clear Channel won’t say who it is.

“It’s not a political sale,” he said. “It’s an independent advocacy ad, and the payment information doesn’t have to be disclosed.”

I asked him if Clear Channel charged the ad buyer full price or perhaps offered a discount. “We don’t disclose rates,” he said.

The ads sure look political to me: One of them thanks three local legislators for supporting the infrastructure bonds — Migden, Don Perata and Leland Yee — and pointedly leaves out another member of the local delegation, Mark Leno, who also supported the bonds, and who happens to be challenging Midgen in next year’s state Senate primary.

But what Colbruno is telling me is that an unknown donor has just done a huge favor for Migden, worth potentially tens of thousands of dollars — and the public will never know who it was.

Leno, not surprisingly, was furious to hear about this:

“The only way this situation can be considered legal is if the suggestion is that these billboards are issue-advocacy ads and not campaign related — but anyone who believes that is a fool,” Leno told me. “If anyone tried to thank me this way, I would tell them no and make them take it down.”

I’m pretty dubious, too — I’m sure Migden knows who paid for the ads, and she ought to tell the rest of us.

A chance to end police secrecy

EDITORIAL There’s still a chance to restore sunshine to police disciplinary records, but it’s going to take strong and visible support from public officials around the Bay Area.

A bill authored by Sen. Gloria Romero (D–Los Angeles), SB 1019, would allow the public limited access to hearings and reports on police misconduct. That’s nothing new; the San Francisco Police Commission has held disciplinary hearings in public for years. But a 2006 state Supreme Court decision, Copley v. Superior Court, barred that practice, giving peace officers a stunning and unprecedented level of protection from public oversight.

All the Romero bill would do is restore the law to where it was pre-Copley. It makes perfect sense: cops have immense authority and power, and when they abuse it, the public loses faith in the law enforcement process. As San Francisco sheriff Mike Hennessey points out in a letter supporting SB 1019, shedding some light on the system and ensuring that officers who are suspended or terminated for misconduct can’t avoid public scrutiny "will help law enforcement by allowing it to inform the public that internal discipline within public safety agencies is a serious matter and that steps are being taken to maintain that discipline."

Assemblymember Mark Leno (D–San Francisco) tried earlier this year to overturn the Copley decision, but his bill was bottled up in the Assembly Committee on Public Safety. Even his San Francisco colleague, Fiona Ma, wouldn’t vote in favor of the bill. Romero, the Senate majority leader, has done a bit better: SB 1019 squeaked through the Public Safety Committee on a 3–2 vote and is now headed for the Senate floor.

The vote there will be close too: the police secrecy lobby has pulled out all the stops to fight this, and even Democrats in Sacramento are afraid of offending police organizations. That’s why it’s important that community leaders around the Bay stand up and make clear that this is a bill with broad-based support.

The San Francisco Police Commission has endorsed it, as have the San Francisco supervisors. The city councils of Oakland and Berkeley are on record as supporting it. But we haven’t heard from Mayor Gavin Newsom or Oakland mayor Ron Dellums; both need to speak out in favor of the bill and let Romero know that she has their support.

Sen. Leland Yee told us he fully supports the bill; so does Sen. Carole Migden. So far, though, Don Perata, the State Senate president pro tem who represents Berkeley and Oakland — cities that have long-established police oversight agencies — hasn’t take a position. He needs to not only endorse the bill but use the considerable power of his office to push for its passage. Every vote will count on this one, and Perata’s constituents should let him know that they’re watching. *

Ellis Act crisis

OPINION Between 2004 and 2005, Chetcuti and Associates, a Walnut Creek real estate development company, bought eight Mission District apartment buildings. Within the first few weeks of ownership, the company served all the tenants in four buildings with Ellis Act eviction notices. In the next two months, three of the other buildings were Ellised. The company held on to the eighth building for a year before it gave those tenants Ellis notices.

The same is true throughout the city: John Hickey Brokerage, another out-of-town real estate company, gave Lola McKay (who died in 2000 while fighting her Ellis eviction) a notice within weeks after buying the building and then did the same to tenants in a North Beach apartment building – evicting those tenants just five days after a purchase deal closed.

In fact, more than half of all Ellis Act evictions in San Francisco are done by real estate speculators who have owned their buildings for less than six months. Almost one quarter are done by speculators who have owned the building for less than a month (and many of those are done in the first hours or days of ownership).

The buildings are then often sold as tenancies in common – essentially, as condos for people much wealthier than the ones who were evicted.

Rampant real estate speculation is bad enough on its own. What makes it worse is that this pattern is also an abuse of everything the Ellis Act was intended to be: a way for long-term landlords to be able to get out of the rental business and retire. When the Ellis Act was passed in 1985, its proponents said its purpose was to allow a landlord "to go out of business when he or she is convinced that they are no longer willing to devote the time, accept the frustration, expose themselves to the liability and other factors of continuing to be a landlord."

Apparently, companies such as Chetcuti and Associates and John Hickey Brokerage decided within days and weeks that they just couldn’t devote the time to or accept the frustration of being a landlord anymore and were compelled to evict the tenants. And that’s the case for hundreds of other real estate investors, many of whom are getting tired of being landlords within days of buying rental property.

Senate Bill 464 – which the State Senate will vote on any day now – would rectify this abuse and return the Ellis Act to its original intent. This bill simply says that a landlord must own property for at least five years before using the Ellis Act to evict tenants. It’s simple and fair, and it hurts only real estate speculators.

The vote is expected to be close – and unbelievably, the bill may not pass because a senator from San Francisco, Leland Yee, has indicated he may oppose it. No other city in California has been hit harder by the Ellis Act than San Francisco – yet our very own senator may kill this bill.

Thousands of residents here have been evicted under the Ellis Act, most of them senior or disabled. Ellis evictions are a crisis in San Francisco and are destroying lives and neighborhoods and communities.

A critical piece of tenant legislation is heading for the floor of the state Senate, and so far, San Francisco Senator Leland Yee hasn’t taken a position on it. The bill would dramatically reduce the number of Ellis Act evictions in the city and save the homes of thousands of low-income renters and seniors.

Blood in the water

Mayor Gavin Newsom has long been considered a lock for reelection next year, a belief driven by his same-sex marriage gesture, hoarding of political capital, personal charm, and high approval ratings. Yet Guardian interviews with more than 20 political experts and insiders from across the ideological spectrum indicate that Newsom may now be more vulnerable than ever.
Just as San Francisco politicians are starting to calculate whether to run, the Newsom administration has suffered a series of political setbacks. In November alone, most of Newsom’s picks got spanked during the election, his veto of popular police foot patrol legislation was overridden by the Board of Supervisors, and he was caught off guard by the San Francisco 49ers’ announcement that they were moving to Santa Clara, taking with them Newsom’s hopes of landing the 2016 Summer Olympics.
“Until recently, I didn’t have a lot of hope,” Sup. Chris Daly, whom Newsom unsuccessfully worked to defeat, told us. “Now the progressives have a glimmer of hope. The mayor seems to be hurting from three or four episodes where he was caught with egg on his face.”
To many political observers — most of whom the Guardian allowed to speak anonymously in order to capture their most candid observations and plans — the defeats were indicative of a mayor who seems increasingly disengaged and out of touch. Even Newsom’s strategy of avoiding fights that might hurt his popularity has rankled many of his allies, who complain that this risk-averse approach has allowed the Board of Supervisors to effectively set the city’s agenda.
“This guy does not use one scintilla of his political capital on anyone or anything,” said former mayor Art Agnos, whose name has been dropped as a possible challenger to Newsom but who told us, “I’m not running.”
There are a number of strong anti-Newsom narratives out there, even on his signature issues, such as crime and homelessness, which persist as visible, visceral problems despite increased city spending on homeless services and controversial tactics like police sweeps and one-way bus tickets out of town for vagrants.
The mayor started his term by announcing during a radio interview that if the murder rate rose, he should be ousted from office. It did — remaining at 10-year highs through the past three years — handing his potential opponents a ready-made sound bite. The crime rate could be a powerful weapon when paired with Newsom’s failure to follow up on promises of police reform.
Newsom is still likely to offer up a long list of accomplishments in his usual statistics-laden style. But much of what he tries to take credit for was actually someone else’s initiative, such as the universal health care measure crafted by Sup. Tom Ammiano (who is running for the State Assembly and not taking a third run at the mayor’s office). Adding to Newsom’s problems in November was the lawsuit the Golden Gate Restaurant Association — a Newsom ally — filed challenging the measure.
Almost everyone we interviewed agreed that if Newsom does have approval ratings of around 80 percent, as has been reported, that support is very soft and may significantly erode during the campaign. “His support is an inch deep and a mile wide” was how one political analyst put it.
“His ‘skyrocketing’ approval rating is irrelevant,” one downtown politico told us. “People approve of the mayor like they approve of the color beige. If you fill an arena with 50,000 people and ask them to decide on what color to paint the walls, that color will always be beige. It’s not that they necessarily like beige; it’s that they will accept it as long as those freaks who want hot pink don’t get their way.”
And then there are his personal foibles. Newsom’s choice of girlfriends — from the Scientologist actress to the 19-year-old hostess — has found its way into print and caused the mayor to lash out in brittle ways that have hurt his relations with once-friendly outlets like the Chronicle, which openly mocked Newsom’s televised comments last month about how hard his job is and how he might not run for reelection.
Finally, there are the new electoral realities: this is the first mayor’s race in which challengers will receive public financing from a $7 million fund (almost all of which, Newsom campaign manager Eric Jaye argues, will be aimed at doing damage to Newsom) and the first with ranked-choice voting, allowing candidates to run as a team and gang up on the mayor.
Add it all up, and Newsom looks vulnerable. But that’s only the first part of a two-part question. The trickier part is who can run against Newsom, and that’s a question to which nobody has any good answer yet.
THE FIELD
Among the names being dropped for a mayoral run are Dennis Herrera, Aaron Peskin, Ross Mirkarimi, Matt Gonzalez, Kamala Harris, Mark Leno, Agnos, Susan Leal, Angela Alioto, Lou Girardo, Warren Hellman, Jeff Adachi, Tony Hall, Leland Yee, Daly, Michael Hennessey, Quentin Kopp, and Carole Migden. That’s quite a list.
Yet most say they are disinclined to run this time around, and none are likely to announce their candidacies in the near future, which is when most observers believe a serious run at Newsom would have to begin. Here’s the catch-22: nobody wants to run against Newsom unless his approval rating sinks below 60 percent, but it’s unlikely to sink that low unless there are rivals out there challenging him every day.
Two candidates who already hold citywide office and could aggressively challenge Newsom on police issues are Sheriff Hennessey and District Attorney Harris, both of whom have mainstream credentials as well as supporters in the progressive community. But both have expressed reluctance to run in the next mayoral election, at least in part because they’re also standing for reelection this fall and would need to leave their jobs to run for mayor.
Public Defender Adachi is a favorite of many progressives and could also run on police reform, but his job of representing sometimes heinous criminals could be easy for the Newsom team to attack Willie Horton–<\d>style.
Many of the strongest potential candidates are thought to be waiting four more years until the seat is open. City Attorney Herrera can take as much credit as Newsom for gay marriage and is a tough campaigner and formidable fundraiser who has clearly been setting himself up for higher office. Assemblymember Leno has won over progressives since his divisive 2002 primary against Harry Britt and could be mayoral material, particularly because he’s termed out in two years. But both are allies of Newsom and reluctant to run against him.
Several supervisors and former supervisors would love to beat Newsom, but the road seems steep for them. Daly just got beat up in his own reelection, so his negatives are too high to run again right now. Supervisor Mirkarimi might run, but some consider him too Green and too green and are urging him to wait four more years. Board President Peskin could also be a contender, but some doubt his citywide appeal and note a few bad votes he’s cast.
Challenges from Newsom’s right could include Kopp, the former legislator and judge; Hall, the former supervisor whom Newsom ousted from his Treasure Island post; businessman and attorney Girardo; financier and philanthropist Hellman; and Alioto, who ran last time. But these would-be challengers are generally less liberal than Newsom, who pundits say is as conservative a mayor as a town with an ascendant progressive movement will tolerate.
Finally, there’s Gonzalez, who four years ago jumped in the mayor’s race at the last minute, was outspent by Newsom six-to-one, and still came within less than five percentage points of winning. Many progressives are urging him to run again, noting that he is still popular and has the political skills to highlight Newsom’s shortcomings. But Gonzalez remains cagey about his intentions.
“I don’t believe I’m running for mayor. The chances are slim,” Gonzalez told us. “But I think he needs to be challenged.”
TEAM NEWSOM
Newsom campaign manager Jaye says he’s definitely expecting a challenge. And unlike most observers whom we spoke with, who are surveying the field and not seeing many people jumping in, Jaye expects a crowded free-for-all and a tough race.
“Is it likely to be a highly contested mayor’s race? Sure. Is that a good thing? Yes, I think it is,” Jaye said. “Every race in San Francisco is tough. The school board races here are fought harder than some Senate races.”
But Jaye thinks the new public financing system — in which mayoral candidates who can raise $135,000 will get $450,000 from the city — will be the biggest factor. “That’s one of the reasons I think everyone’s going to run,” Jaye said. “That guarantees it will be a crowded field.”
One political analyst said that’s the best scenario for defeating Newsom. He said dethroning the mayor will be like a pack of jackals taking down an elephant. No single challenger is likely to beat Newsom, but if he’s being attacked from all sides, he just might fall.
As for Newsom’s weaknesses and missteps, Jaye doesn’t agree the mayor is particularly weak and doesn’t think people will turn away from Newsom because of his candid comments on how the job cuts into his personal life.
“One of the reasons so many people like Gavin Newsom is he’s not afraid to be human in public and to be honest,” Jaye said, adding that his candidate is up for the challenge. “He is running for real and will run a vigorous race.”
Jaye concedes that the 49ers issue is difficult: Newsom will be hurt if they leave, and he’ll be hurt if he appears to give up too much to keep them here. The high murder rate and inaction on police reform are widely considered to be vulnerabilities, but Jaye said, “Gavin Newsom gets up every day and works on that problem, and if voters think another candidate has a better solution, they’ll look at it.”
Everyone agrees that candidates will enter the race late — which is what happened during the last two mayor’s races and is even likelier with public financing. If Newsom takes more hits or can’t get his head into the game, the sharks will start circling. “The next three months with what happens with the mayor will be telling,” another political insider told us.
One test will be with Proposition I, the measure voters approved Nov. 7 asking the mayor to show up for a monthly question time before the Board of Supervisors. Newsom reportedly has said he won’t come, which could look cowardly and out of touch to the voters who approved it and to the supervisors, who might make great political theater of the no-show. And if Newsom does decide to show up, most observers believe he might not fare well in such an unscripted exchange.
If Newsom implodes or appears weak in late spring, suddenly all those political heavy hitters will be forced to think about getting in the fray. After all, as just about everyone told us, nine months is like an eternity in San Francisco politics — and Newsom has the best job in town.

The Race is On: Candidates for local Nov. 7 races

Sixty-six took out papers. Forty-one filed, meaning that over one-third of the potential candidates in local races in the Nov. 7 election, bailed before the train even left the station.

So who’s in the running?

On the Board of Supes front, there are five races.
District 2 incumbent Michela Alioto-Pier, who has not accepted the voluntary expenditure ceiling and does not intend to participate in the public financing program, faces one lone challenger: business management consultant Vilma Guinto Peoro, who has accepted a voluntary expenditure ceiling and intends to participate in the pubic financing program.

In District 4, seven candidates are vying to fill the vacancy Sup. Fiona Ma created as Democratic nominee for Assembly District 12, (where she is running against the Green’s Barry Hermanson.) Mayor Gavin Newsom has endorsed Doug Chan, who lent his name to PG&E’s anti-Prop. D campaign, has not accepted voluntary expenditure ceiling and does not intend to participate in public financing campaign. Chan, who also got Ma’s endorsement and has served on the San Francisco Police Commission, Board of Permit Appeals, the Rent Board and the Assessment Appeals Board, has promised to return SFPD to its legally-required numbers (it currently operates 15 percent below voter-mandated leval), and upgrade policies, practices and technology, and would likely become the establishment conservative on the Board,

Other contenders are business consultant Ron Dudum, who lost against Ma in 2002 and against then Sup. Leland Yee in 2000, anti-tax advocate Edmund Jew, who would also be popular with the district’s conservative base, and San Francisco Immigrant Rights Commissioner and Fiona Ma-supporter Houston Zheng, David Ferguson, Patrick Maguire and Jaynry Mak, though Neither Maguire nor Mak, who has already raised $100,000, had filed papers as of Aug. 11, perhaps because District 4 has a Aug. 16 filing extension, thanks to departing incumbent Ma.

District 6 incumbent Chris Daly, who has accepted voluntary expenditure ceiling and intends to participate in public financing campaign, appears to face the biggest fight—at least in terms of numbers, with seven challengers hoping to fill his shoes. Of these Mayor Gavin Newsom has portrayed former Michela Alioto-Pier aide Rob Black, who has accepted voluntary expenditure ceiling and intends to participate in public financing campaign, as “the best contender to lessen divisiveness in the district.”
Fellow challengers are Mathew Drake, Viliam Dugoviv, Manuel Jimenez , Davy Jones, Robert Jordan and George Dias.

District 8 incumbent Bevan Dufty faces stiff opposition from local resident and Oakland deputy city attorney Alix Rosenthal, who was instrumental in turning around the city’s Elections Department, has worked on turning the former Okaland Army Base over to the Redevelopment Agency and has helped rebuild the National Women’s Political Caucus. Rosenthal, who is running on a platform of affordable housing, sustainability and violence prevention, also wants to keep SF weird.

In District 10, Incumbent Sophie Maxwell, who says a November ballot measure opposing the Bayview Redvelopment Plan is based on fear and unfairness, has five challengers: Rodney Hampton Jr., Marie Harrison, Espanola Jackson. Dwayne Jusino, and former Willie Brown crony Charlie Walker. Of these, the most serious are Harrison, helped shut down the Hunter’s Point PG&E plant and has worked for decades to fight all the pollution that’s being dumped on southeast residents, and Espanola Jackson, who has fought for welfare rights, affordable housing, seniors and the Muwekma Ohlone.
In other races, Phil Ting runs unopposed as Assessor-Recorder.
18 challengers are fighting over three seats on the Board of Education, one of which is occupied by incumbent Dan Kelly, and six candidates are vying for three seats on the Community College Board, one of which is occupied by incumbent John Rizzo.

Endorsements for Nevin

At Mike Nevin’s Election Party

At District 8 State Senate candidate Mike Nevin’s election party, the mood is subdued. At the front of the wood-paneled meeting hall of the Steam Fitters, Plumbers, and Refrigerator Fitters Local 467 in Burlingame, an eraser board shows opponent Leland Yee ahead by 11 percentage points, with 50 percent of precincts reporting.

Nevin supporters chant, “I like Mike,” but the outcome seems inevitable to everyone, including Nevin.

After a series of supporters and campaign volunteers make short speeches, Nevin appears before the crowd with his family and declares, “Only 50 percent of the votes are in, but I’ve always been a pretty good counter all of my life, and I’m pretty aware of what’s going on tonight.”

He goes on to thank his campaign staff; his wife jokes that her husband has been endorsed by God, the Pope, and even, somehow, Yee.

“One thing people have always said about me is that I have political purpose,” he says, adding that that’s why he pursued the now more than two-years-long campaign.

OK, we can now fairly safely project most of the local races. Leland Yee is way ahead in SF, and trailing only slightly in San Mateo, so Yee will be our next state senator. Janet Reilly isn’t looking good at all, so we may be facing Assemblymember Fiona Ma (ick, I’m voting for the Green Party candidate, Barry Hermanson).

On the props:

Prop. A, the violence-prevention measure, is coming up fast, winning the election-day vote by 51 percent, and will almost certainly prevail.

Prop. B, the eviction-disclosure measure, is a winner.

Prop. C, the Transbay Terminal governance plan, is toast.

Prop. D, the Laguna Honda measure, is burnt toast.

Just across the Daly City border on the sleepy southern reaches of Mission Street, State Senate District 12 candidate Leland Yee has yet to show up to his election party. It was 8 p.m. when I arrived, and about 200 supporters were mingling anxiously. Cheers erupted when a voice announces that Yee is racing past Mike Nevin in San Francisco absentee ballots 66 to 34 percent. But the two are stilll running a dead heat in San Mateo County at 40 percent. In both counties, Lou Papan is wavering between 15 and 20 percent. Yee campaign consultant Jim Stearns said that predictions that Papan would spoil the race appear to be not true, “at least right now.” He says it’s still not clear how some of the late-stage negative campaigning would impact final results.

First results are in, mostly the more-conservative absentees, and even so, there are some surprises. Leland Yee is way, way ahead in the state senate races, 66 percent to 27 percent (although part of the district is in San Mateo, so Yee can’t quite celebrate yet.

Fiona Ma is well up on Janet Reilly, 58-41.

In the governor’s race, Angelides and Westly are close, but Angelides is ahead, 47-44 percent. Remember, this is among absentees. I’d say that a good sign of Angelides taking San Francisco easily — let’s see what it means for the rest of the state.

The San Francisco Board of Education agreed this month to spend a little north of $1.3 million fixing up some dilapidated bungalows at Rooftop Elementary, which happens to be one of the most popular schools in the district. This sounds like a fine idea. The school has too many kids to fit in the classrooms, and the outdoor bungalows, which handle the overflow, are in pretty bad shape. The school district’s facilities officer, an architect, says the students are in no immediate danger, but seriously: How can anyone be against repairing rotten old school buildings?

Well, I’m against it.

Here’s the thing: The board just shut down a bunch of schools, many of them serving primarily nonwhite populations, to save a few million bucks. The rationale: The district is short of money, and those schools were underenrolled there were too many empty spaces in the classrooms. So they could be closed and the kids sent to other schools. Closing John Swett in the Western Addition, for example, infuriated a large African American community, but saved around $650,000.

Now think about this slowly for a moment, and see if it makes any sense to you: We’ve got a school that has too many kids, so they’re crammed outside in old bungalows. And we’ve got a school that has empty classrooms, so we’re going to shut it down. Instead of trying to move some of the kids from Rooftop to Swett which costs nothing we’re saving $650,000 by closing Swett, then spending twice as much as we saved rebuilding the Rooftop bungalows.

Isn’t there something really screwy here?

Well, of course, there’s an explanation: Rooftop has a long waiting list, and all the upper-middle-class white people want to send their kids there. I understand it’s got a great program, great teachers, and a parent community that raises a ton of money every year for curriculum enrichment.

And I know I’m not as smart as all the people with advanced education degrees at school district headquarters. But I have to wonder: Why can’t we take what’s good about Rooftop a couple of the teachers, the overall program approach, maybe even (gasp) some of that fundraising cash and, you know, export the revolution? Why not make Swett sort of a Rooftop Annex? Save the money, help the kids, don’t close anything everybody’s a winner.

Sarah Lipson, one of two school board members who opposed the bungalow rebuild (Mark Sanchez was the other) told me the whole deal was crazy. "How can we talk about long-range planning and then do this?" she asked.

The district wouldn’t have to kick anyone out of Rooftop this year the bungalows aren’t going to fall off the hillside, and they’ll hold up another 12 months. There’s supposed to be a real community-based process to evaluate facilities and school closures anyway; why not make this part of it?

Do I really have to answer that question?

Now this: The attack ads and scare tactics of this spring’s campaign are even worse than usual. The "shocking secret" flyer, with the older woman with a photoshopped black eye, attempting to convince people to vote for Proposition D, ranks number one on the sleaze list. San Francisco needs better candidates

The last time we had a major Democratic primary race for state assembly in San Francisco, you didn’t see a lot of head-shaking. In 2002 you were for Mark Leno or you were for Harry Britt, and either way you had very few doubts. Two strong candidates, two people who were eminently qualified to represent San Francisco in Sacramento, two people who had the credentials to be Democratic party leaders.

But I’ve talked to a lot of people about the June 6, 2006, race to fill the spot of Assemblymember Leland Yee, who is trying to move on to the state senate, and what I’m getting is: Gee, well, yeah. Gotta vote for somebody.

The thing is, Sup. Fiona Ma, the front-running candidate, has been absolutely horrible in office, a terrible vote on everything I care about. Her lukewarm supporters say she’d be a good liberal compared to most of the state legislators, and that may be true, but it’s hardly a ringing endorsement. Her opponent, Janet Reilly, is taking some excellent stands on issues, running hard to the left of Ma but she’s never held any elective office before, and, frankly, not that many people in San Francisco even know who she is. If she didn’t have a lot of money, she wouldn’t be much of a factor in this race.

Then you look slightly southward, at the race for state senate. The candidates: Yee, who has done almost nothing to distinguish himself in the state legislature, and Mike Nevin, a former San Francisco cop and San Mateo County supervisor. I don’t know a single person in the progressive San Francisco world who can get a bit excited about either of them.

San Francisco has got to start doing better.

Leno’s term will be up in two more years. I can think of a lot of great Democratic candidates (Tom Ammiano, Chris Daly, Robert Haaland), but we all ought to be thinking about it, now, the same way we need to be thinking about the next mayor of San Francisco and the next member of Congress. Otherwise we’ll have a lot of Fiona Mas and Bevan Duftys in our future.

Now this: Speaking of politicians who need to get out of the way, Leslie Katz, the chair of the local Democratic County Central Committee, recently pulled an act of world-class political sleaze. She opposes Sup. Chris Daly’s Proposition C, a measure that would force the mayor to serve on the Transbay Terminal board, but the committee wasn’t quite ready to take a stand. So March 22, shortly after noon, she filed an official no-on-Prop.C ballot argument on behalf of the San Francisco Democratic Party.

In other words, she decided on her own to file a legal document to appear in the ballot handbook committing the party to a position it hadn’t taken.

In the end the party did vote later to oppose Prop. C. But Katz sent a clear signal that she had the committee wired and wasn’t even going to wait for the formality of an actual vote. Nasty business. It sends the exact wrong signal about the local party. She ought to resign in disgrace.<\!s><z5><h110>SFBG<h$><z$>
