Higher wages and tenants’ rights, for the win

As we document in this week’s cover story, a citywide coalition has sprung up to fight for tenants’ rights in the face of mounting evictions and soaring rents, and momentum on this issue is steadily growing.

But that isn’t the only sign of a newly invigorated movement that’s beginning to count its victories and advance forward on behalf of tenants, workers, and thousands of San Franciscans who are less focused on turning a quick profit and more concerned with bringing about positive change. Last week brought several high notes on this front.

Citywide legislation that will limit discriminatory practices by employers and housing providers by reforming background check policies won initial approval at the Feb. 4 San Francisco Board of Supervisors meeting.

Introduced by Sup. Jane Kim, the Fair Chance Act is part of a “ban the box” movement, backed by local grassroots organizations that came together to champion the rights of individuals who’ve encountered barriers to improving their lives due to past convictions that have left them with a permanent stigma.

At the meeting, Kim mentioned a woman who’d been told she “need not apply” for a job working as a cook — because of a simple shoplifting conviction from when she was in high school. The ordinance will require certain employers and housing providers to refrain from criminal history checks until after an initial job interview, and would make certain kinds of information off-limits, such as arrests that never resulted in a conviction.

Meanwhile, an initiative to curb height limits on waterfront development amassed enough signatures last week to qualify for the June ballot. That effort grew out of a successful referendum last November against the 8 Washington project, a key pushback where San Francisco voters rejected luxury condominiums at the ballot.

The Chinese Progressive Association and Jobs With Justice held a celebration last week to commemorate the 10-year anniversary of the passage of the city’s minimum wage ordinance.

While it remains the highest in the nation, San Francisco’s 2014 minimum wage of $10.74 an hour still isn’t enough to make ends meet, so allies of low-wage workers are launching the Campaign for a Fair Economy to push for a higher minimum wage at the ballot and to implement a higher wage standard for major retailers and chain stores.

There remains much to rail against, to be sure. A Craigslist ad for a $10,500-per-month two-bedroom apartment in the Mission generated a barrage of angry commentary from those who read it as doomsday for the historically Latino area, especially since the tone-deaf author used the word caliente to describe the neighborhood.

But the start of 2014 has already delivered some promising victories for progressives, and many have their sights set on even greater horizons.

 

Former supervisor displaced after Christmas Day fire

A fire broke out on Christmas night at the home of Christina Olague, a former San Francisco supervisor, and fatally injured her housemate and longtime friend, Randy David Sapp.

Now, Olague’s friends and supporters are holding an online fundraiser to help her get back on her feet in the wake of the tragic event. A benefit has also been planned for Jan. 12 at El Rio.

Olague said she has been staying with friends since the fire, and doesn’t know where she will wind up living in the long run. She said she’d wanted to be respectful of her housemates’ privacy before making any public statements about what happened, and didn’t reach out to many people initially because she was in a state of shock.

She told the Bay Guardian she had lived in the Victorian, located on Baker Street, for more than four years. Her housemates included Sapp, his partner, Patrick Ferry, and Olague’s sister.  She said she’d been friends with Sapp and Ferry for more than 15 years.

When the fire started on the evening of Dec. 25, Olague said, she was downstairs talking to a friend on the phone, and Sapp and Ferry were upstairs. “All of a sudden the commotion started,” she remembered. It was classified as a 3-alarm fire, and both were rushed to the hospital with serious burn injuries. Olague and her sister were unharmed. Sapp died from his injuries the following day.

The cause of the fire remains unknown, Olague said.

Sapp and Ferry were co-owners of a Cole Valley shop, The Sword and Rose, which sells incense, oils, and books. Olague said Sapp was also a musician, and described him as “a kind, understanding human being.” She said, “He gave so much to so many people.”

Ferry is still suffering from burn injuries, but is expected to recover fully.

Gabriel Haaland, a longtime activist and labor organizer, created an online fundraising website to help Olague upon hearing the news. He’d texted her randomly, he said, only to learn that “she’d lost her home and her best friend died. I was just blown away.”

The fundraising page, created on wepay.com, has raised nearly $4,000 so far from 52 donors.

“After a long discussion, she agreed to let people know this happened, and at my urging accepted that she needs financial assistance as well with getting a new apartment and getting back on her feet again,” Haaland wrote in a statement on the fundraising website.

In addition, Haaland said a fundraiser is being coordinated by Sups. David Campos, Jane Kim and Eric Mar. It will be a Salsa Sunday at El Rio and is scheduled to be held from 3 to 8 p.m. on Jan. 12.

With more bikes on the roads, Folsom Street gets a makeover

As anyone who has traveled the streets of San Francisco knows, there’s an increasing number of bicyclists out there. And the just-released biennial bike count from San Francisco Municipal Transportation Agency attempts to quantify that increase: 14 percent since 2011.

The agency counted bikes at 51 key intersections around the city during the afternoon/evening commute from Sept. 10-19, counting a total of 23,225 bikes. Comparing 40 counted intersections in 2011, that’s a 14 percent increase; or a 96 percent increase since 2005 when comparing the 20 intersections measured then.

The San Francisco Bicycle Coalition trumpeted the report as good news, including in its press release this quote from Mayor Ed Lee: “Every year we are seeing more people riding a bicycle in San Francisco, and the latest bicycle count data proves it.” And SFBC Executive Director Leah Shahum said, “It’s clear that if we build it, they will come. No other mode of transportation is growing as fast or has a higher return on investment in terms of improving our city for everyone.”

But the reality is that the city is lagging far behind its own stated goals to make cycling a safer and more attractive transportation options, largely because of a severe underinvestment in its cycling network. The report notes that the city has invested $3.3 million in its bike network since 2011, but that was mostly playing catch-up from when a court injunction stalled all bike projects in the city for four years.

The SFMTA report doesn’t calculate the critical number in terms of how we’re really doing — transportation mode share, or the percentage of overall vehicle trips taken by bike — an estimate it is now working on in a separate study at the end of January.

An American Community Survey in 2012 put SF bike mode share at less than 4 percent, which is a far cry from the 20 percent by 2020 that is the city’s official goal, one it has little chance of meeting without a serious increase in infrastructure investment and other changes. The SFMTA’s own stated goal is 8-10 percent mode share by 2018, the result of failure to make needed investments, which amounts to an admission that the city’s official goal is little more than political pandering.

“We’re still moving forward on all the goals that we set to accomplish, but we do have funding needs,” SFMTA spokesperson Paul Rose told us, instead emphasizing the agency’s goal of attaining a 50-50 split between private automobile use and all other modes of transportation, including Muni and cycling.

The SFBC has worked in close partnership with the city, but the continuation of Shahum’s quote in her press release also indicates that she’d like to see the city doing more to promote safe cycling: “It’s time for the City to truly invest in our bicycle network, and ensure that our City’s streets are welcoming and comfortable for the growing number of people riding.”

But the city is moving forward with some bike improvements, including a makeover of Folsom Street now underway.

In the wake of some high-profile cases of motorists running over cyclists in San Francisco this year, including the Aug. 14 death of Amelie Le Moullac at the intersection of Folsom and 6th Streets, the San Francisco Municipal Transportation Agency has taken a lane from drivers to create safer cycling along seven key blocks of fast-moving Folsom Street.

The project on one-way Folsom Street between 11th and 4th streets creates an extra wide bike lane with bright green cycling signage on the roadway, with that green lane narrowing and breaking up as it approaches the right turns on 10th, 8th, and 6th streets. The idea is communicate with both motorists and cyclists about how to safely merge and avoid having cars make the unsafe “right hook” turns that are dangerous to cyclists.

“Right now, the project is almost complete and it should be complete by the end of the month,” Rose told the Guardian.

He said the design was discussed and subjected to community outreach efforts during community plan meetings in recent years, but that it was recently accelerated as a $250,000 pilot project with help from Sup. Jane Kim’s office following public concerns about how dangerous that fast-moving strip is to cyclists.

Rose said the traffic flows in the project area will be carefully monitored to see how it’s working, and the agency hopes to learn from that data “so it will inform future projects.”

The San Francisco Board of Education approved a land swap with city government on Dec. 10, gifting San Francisco an empty lot that it will use to build new affordable housing. That’s 115 units of living space for low-income San Francisco renters, wrapped in a bow for the holidays.

The proposal was the brainchild of board members Hydra Mendoza-McDonnell and Sandra Lee Fewer, who worked on the measure with the Mayor’s Office of Housing for over two years. The district will trade a lot on 1950 Mission street and another on Connecticut Street in exchange for a property it currently rents from the city of San Francisco. The city will also pay SFUSD $4.5 million, according to district data.

The deal was the culmination of that work, which Fewer said was the right thing to do.

“Could we get more money from [selling] this property with a private developer? I’m sure. But would we get the value? No,” Fewer said at the meeting.

The original intent of the land swap was to provide affordable housing for the school district’s employees. Project proponents say school district workers are being priced out of San Francisco in droves. But the affordable housing project will be general use, with no specific provisions for teachers or other SFUSD workers.

teachersinSF Though the teachers’ union supports the land swap, United Educators of San Francisco President Dennis Kelly warned that teachers are in dire need.

“It’s more than an oversight, it’s an insult, felt very deeply, and very bitterly,” Kelly said at the podium. “Affordable housing will not house a single teacher, not a single one, because of where the dollar breaks are.”

The board has made various promises over the past decade to aid with teacher housing, all empty words, Kelly told the Guardian. There’s yet to be a solution from the school district or the board on finding sustainable housing for teachers.

The problem is a microcosm of one of San Francisco’s toughest challenges during this tech-fueled affordable housing crisis. Affordable housing helps the poor, and the rich certainly don’t need help staying in the city, but help for middle-income earners is hard to come by.

 

NEW RECRUIT

Research from education nonprofit ASCD shows most first-year teachers face three challenges: difficulty learning to manage classroom behavior, an overload of curriculum creation, and lack of school support. San Francisco’s new teachers face a fourth: finding a place to sleep at night.

Second-year SFUSD science teacher Kate Magary, 29, knows this all too well. Her first year on the job went from challenging to hellish as she looked for an affordable place to live.

Despite having a modestly salaried full-time job, she couldn’t afford a studio on her own. She eventually found a room for rent on Craigslist, but her noisy roommates made grading papers and writing curriculum a constant challenge. She started a new apartment hunt, but even that was like a full-time job.

“As a first-year teacher, it was awful,” Magary said. “I tried not to let it affect me too much at school, but the stress from home eventually made it with me to the classroom.”

She over-disciplined some kids, she said, and her patience was at the breaking point for most of the year. When teachers suffer, students suffer.

Magary is a science teacher at the Academy of Arts and Sciences, which is on the Ruth Asawa School of the Arts campus at Twin Peaks. Three-story homes and apartment buildings dot the hills along the road from Market Street on her drive to school, but Magary can’t afford them.

Instead, she eventually found a place on Treasure Island. A sixth-generation San Franciscan, Magary is happy to stay in what is still technically part of the city. But her lease is tenuous, and she anticipates having to move within the next few years. She’s not alone.

Out of SFUSD’s 3,284 teachers, 927 live outside of San Francisco, according to data from their union. That’s 28 percent of teachers living outside of the city, 3 percent higher than just last year. That number masks the depth of the problem.

New teachers who aren’t established in San Francisco bear the brunt of displacement. Half of all new teachers leave SFUSD in their first five years, according to data from the district. And 35 percent of teachers hired since July 1 live outside the city.

“A teacher might start in the district, live in the city, and move out,” said UESF spokesperson Matt Hardy. “The turnover is very high, particularly in newer schools.”

Teachers we talked to said there are problems for those who manage to stay in San Francisco as well. They sometimes sleep in unstable or unsafe housing, couchsurf, or sleep in their cars. In the morning they teach the city’s children.

It’s bad for teachers, but worse still, it’s bad for students. Recognizing this, federal, state and city government have all pitched in to try and find housing solutions for teachers.

Unfortunately for them, and for us, they’ve mostly failed.

 

OWNERSHIP FOR NONE

Art Agnos is most well known for being San Francisco’s former mayor. But after stepping down in the ’90s, he served in the Clinton Administration as the Department of Housing and Urban Development regional director throughout California, Arizona, Nevada, and Hawaii.

He was in charge of finding folks places to live.

The crisis for teacher housing was stark. At the time, Agnos was in charge of implementing Clinton’s housing program for teachers in San Francisco. The experiment? Build affordable housing units at Dianne Feinstein Elementary School on 25th Avenue exclusively for teachers.

The idea died in a sea of NIMBYism.

“The resistance came from the neighborhood who thought affordable housing for the teachers would diminish the value for their property and make traffic issues,” Agnos told the Guardian. “The Board of Education yielded to that NIMBYism and refused to pursue the deal, which was on the table.”

The federal push for teacher housing died, having created a home for just one teacher in San Francisco by the year 2000, and only 100 in California, according to news reports at the time.

California would follow suit with a less ambitious teacher housing program. The Teacher Next Door program offers assistance for teachers buying homes in San Francisco through the Mayor’s Office of Housing. We called the office to get statistics on its use, but as of press time it had not called back.

Among teachers, the program is mostly a joke.

“That’s the case with most teachers,” science teacher Tom Dallman of Ruth Asawa School of the Arts told the Guardian. “They roll their eyes when it comes to talk about buying a place in San Francisco.”

Median home prices in San Francisco skyrocketed past $1 million in June, a signal that for many teachers, homeownership in the city is a near impossibility.

Subsidized Below Market Rate housing is out of their reach too. San Francisco teachers make anywhere between $40,000 and $80,000 a year, placing them just above the salary as a single person to qualify for affordable housing.

“The struggle is about middle income people who do not qualify for mortgages or newly develop projects, because the market is astronomically high,” Agnos said. And that’s leading to a teacher migration, numbers from the UESF show.

“If they have to live in Oakland, they’ll work in Oakland,” Agnos said. “Their talent will follow them.”

The dream of homeownership for San Francisco’s education workforce is a thing of the past, Susan Solomon, vice president of the UESF told us.

“Maybe long, long ago this was a possibility,” she said, “way back when.”

 

FEW SOLUTIONS

Fewer was ecstatic to see the land swap deal go through, and excited to see affordable housing for San Francisco families.

But when asked what she’ll do to tackle the struggle to find affordable housing for teachers, she said that the upcoming contract negotiations may be the time to revisit a new plan.

“We’ve asked the unions to give us a poll for a long time,” she said. She wants to know what the teachers want. Do they want to live in housing together? Have rental subsidies? Housing assistance? What are their needs?

Sup. Jane Kim, a former school board member, said there’s a split of preference in the union. Should affordable housing solutions be given to teachers in their first five years in SFUSD, to encourage them to stay in San Francisco, or to veteran teachers?

“There’s a limited amount of funding,” Kim told us. And when the district lucks itself into extra funding, it’s hard not to spend it in the classroom. “How do you invest the limited dollars that you have?” she asked.

Santa Clara’s school district built its own affordable housing, and spent $6 million in 2005 to construct 40 units for its workforce. Three years later, they built 30 more units. Teachers there initially paid $1,075 a month in rent for a two-bedroom apartment, according to The New York Times.

“You cannot be an education advocate without being a housing advocate,” Fewer said. But housing help has been largely elusive for SFUSD employees.

“Stubbornness is keeping me in the city,” Magary said. But without some help, that may not be enough.

Proposal seeks to improve prospects for the formerly incarcerated

Questions concerning an individual’s criminal history have been banned from city agency employment applications in San Francisco since 2006. Now Sup. Jane Kim has proposed legislation to expand the reach of that policy into the private sector and affordable housing.

Introduced at the Board of Supervisors Tue/10, Kim’s legislation seeks to eliminate the bias of first impression that has long plagued the formerly incarcerated.

The Fair Chance ordinance builds upon existing city and state-level fair hiring policies, known as “ban the box” policies, already in place. It proposes to extend them to private businesses and affordable housing providers, as a way to remove “unnecessary barriers to stable housing and employment for individuals with conviction records,” according to a description of the legislation issued by Kim’s office.

“The most important thing to remember is that this is not a hiring mandate,” Kim explained in an interview. “We just want to create a process that’s based on merits.” She added, “We’ve also made it so you can only examine a persons arrest record for the last seven years in order to try to establish some sort of hiring standard.”

Existing “Ban the box” policies forbid employers in the public sector from asking prospective employees about prior criminal convictions in the early application process — essentially eliminating the polarizing “Have you ever been convicted of a crime?” check box from online and paper employment applications. Instead, it requires those that would request a background check to at least meet the person in question first. 

And it is a popular theme: “ban the box” policies in some form can be found in 10 states and more than 50 cities nationwide. Gov. Jerry Brown signed California’s version into law back in October, while the city of Richmond established one of the most progressive “ban the box” policies in America, joining Seattle and Philadelphia as major metropolitan areas to have extended the ban into the private sector.

“Our office has been working on this since January, and we’ve spent lots of time talking to other states and municipalities about what has worked for them,” Kim said.

Under San Francisco’s current “ban the box” policy, individuals with prior felony convictions are permitted to withhold the potentially damning information only if they are applying for a position with the city.

But under the Fair Chance Ordinance, which is co-sponsored by Sup. Malia Cohen, that practice would be extended to all jobseekers looking for private-sector work, at establishments with staffs larger than 20 people, as well as applicants for public housing.

The Fair Chance Ordinance wouldn’t place an outright ban on criminal inquiries, just require employers to hold off on background checks until after the interview, theoretically allowing recently integrated individuals an opportunity to contextualize their past indiscretions.

The idea behind the ban is simple. In the age of impersonal Internet applications, prospective employees are often quickly assessed in a binary manner, separating candidates into categories of hire-able or not the instant their applications are submitted.

And in an ultra-competitive job market, checking a box that condemns your past can condemn your future. There have been myriad reports about folks whose applications have been thrown out the moment that checked box is detected, but under Fair Chance, prospective employees would have the opportunity to get in front of their past.

And that’s the idea. “We’re just trying to help people get a foot in the door,” Kim said. “And we’re just trying to get folks to apply. A lot of [formerly incarcerated individuals] won’t even apply for jobs, because of the ‘box.’”

While San Francisco planners try to learn from other bike-friendly cities, particularly in Europe, Rose also said the agency is on the cutting edge in this country of trying to create safer conditions for the rapidly growing community of cyclists in San Francisco.

“A lot of the work we do in San Francisco generally is the first around country. One of those is sharrows,” Rose said, referring the cyclist shared arrow (sharrow) markings that are ubiquitous around San Francisco, and which remind motorist to safety share the road. 

Serial evictors named in mapping project

The San Francisco Anti-Eviction Mapping Project – the same tenant advocates who produced this time-lapse of Ellis Act evictions – have published a new interactive data visualization, displaying locations of properties where seniors and disabled tenants were ousted by no fault of their own.

Showing data over the last three years, the map plots locations of where tenants were evicted under the Ellis Act, and displays the identities of the responsible landlords for each affected unit.

“Waiting lists for public senior housing take years. Often senior and/or disabled tenants are forced to leave San Francisco altogether, or end up on the street homeless,” Anti-Eviction Mapping Project organizers wrote in a statement accompanying the interactive map. “If dispossessed from the city, they often lose access to vital city-subsidized healthcare and community support that they had been reliant upon.”

At today’s (Tue/26) Board of Supervisor’s Meeting, legislation seeking to assist seniors affected by Ellis Act evictions won preliminary approval by the full board. Called the Ellis Act Displaced Emergency Assistance Ordinance, it prioritizes evicted seniors when they seek to access affordable housing programs administered by the city.

“We need this measure to keep residents who have no other means of permanent housing from becoming homeless,” said Board President David Chiu, who cosponsored the legislation along with Sups. David Campos, Jane Kim, Eric Mar and London Breed.

The Anti-Eviction Mapping Project also released a time-lapse plotting the total number of no-fault evictions from 1997 to 2013. A counter that starts when you hit the play button breaks down the number of units where evictions were carried out under the Ellis Act, via owner move-in evictions, and through demolition.

The grand total for that timeframe is 11,766 no-fault evictions. That’s counting units, not individual tenants. Owner move-in evictions made up the lion’s share, with 6,952 units affected. Watch the visualization here.

Meanwhile, tenant advocates who are developing these data-driven presentations are also conducting a survey to gather information for another mapping project in the works.

STREET FIGHT Parking reform is one of the most radically important elements of making San Francisco a more livable and equitable city.

In this geographically constrained city, parking consumes millions of square feet of space that could be used for housing, especially affordable housing in secondary units. Curbside parking in the public right of way impedes plans to make Muni more reliable for hundreds of thousands of transit riders. Parking in new housing and commercial developments generates more car trips on our already congested and polluted streets, slowing Muni further while bullying bicyclists and menacing pedestrians.

Fundamentally, parking is a privatization of the commons, whereby driveway curb cuts and on-street parking hog the public right-of-way in the name of private car storage. The greater public good — such as reducing greenhouse gas emissions and enhancing public safety through bike lanes, wider sidewalks, public green spaces, and transit-first policies — is subsumed to narrow private interests. These are among the many reasons why, for over a decade, parking reform has been a key part of progressive transportation policy.

Yet lately, it has been disappointing to watch progressives, especially on the Board of Supervisors, retreat from that stance. In Potrero Hill and North Mission, a vitriolic reaction has slowed rollout of nationally acclaimed SF Park, which raises revenue for Muni and is a proven sustainable transportation tool. Yet there are murmurings that some progressive supervisors might seek an intervention and placate motorists who believe the public right-of-way is theirs.

On Polk Street, some loud merchants and residents went ballistic when the city and bicycle advocates proposed removing curbside parking to accommodate bicycles. The city, weary of Tea Party-like mobs, ran the other way, tail-between-legs. Progressive supervisors seem to have gone along with the cave-in.

Along Geary, planning for a desperately needed bus rapid transit project drags on. And on. And on. And on. The lollygagging includes bending over backward to placate some drivers who might be slightly inconvenienced by improvements for 50,000 daily bus riders.

One thing that is remarkably disturbing about this backpedaling is that, in an ostensibly progressive city by many measures (civil rights, tolerance, environmentalism), the counterattack is steeped in conservative ideology. That is, conservatives believe that government should require ample and cheap parking, whether in new housing or on the street. This conservative ideology, shared by many car drivers and merchants — and even by some self-professed progressives — is steeped in the idea people still need cars. This despite the evidence that cars are extremely destructive to our environment, socially inequitable, and only seem essential because of poor planning decisions, not human nature.

Progressive backpedaling has become more confusing with the recent debate over 8 Washington, defeated at the polls Nov. 5, and on the same day of a convoluted Board of Supervisors hearing on a proposed car-free housing development at 1050 Valencia. Both of these projects highlight the muddled inconsistency emerging among progressive supervisors.

Enough has been written about how 8 Washington was a symbolic battle for the soul of San Francisco. But during the campaigns, the lack of attention to parking was curious. Notably, progressive-leaning transportation organizations like the San Francisco Bicycle Coalition, Walk SF, and Transform sat out the election despite the project’s excessive 327 underground parking spaces, which violated hard-fought progressive planning efforts to make the waterfront livable. The Council of Community Housing Organizations also sat it out, despite benefitting from the progressive parking policies that 8 Washington violated. It appears that despite their transit-first rhetoric, progressives made a tactical calculation to keep parking out of the campaign.

The progressive victory came with a Faustian bargain which involved ignoring parking. To ensure 8 Washington was defeated, conservative voters were folded into the opposition. Groups like Eastern Neighborhoods United Front (ENUF), the Coalition for San Francisco Neighborhoods, and the Republican Party came out against 8 Washington and yet, ironically, all are opponents of progressive parking reform.

Moving forward, whatever happens at the 8 Washington site must include progressive parking policies. Don’t expect this from the unimaginative leadership at the Port, which speciously demanded the excessive parking. Don’t expect it from the developer, who steadfastly insists that the rich must have parking. And don’t expect conservatives to latch on to a waterfront scheme that is both publicly accessible and genuinely transit-oriented. It is progressives who will need to muster political will for a zero-parking project at the waterfront and set the tone for consensus among the other factions in the waterfront debate.

Meanwhile on the same day 8 Washington went down, 1050 Valencia barely made it out of a tortuous Board of Supervisors hearing in which progressives seemed to be the antagonists. As the first car-free market-rate housing proposal on Valencia under progressive parking reforms, this 12-unit mixed use building seemed an obvious win for progressives. It would be a walkable, bicycle-friendly urban infill mixed-use project with on-site affordable housing, all of which the city needs more of.

Yet since 2010, when the project first went to the Planning Commission, conservative rhetoric has been deployed to stop the project. Significantly, the Liberty Hill Neighborhood Association objected to the transit-oriented characterization of the project. It claimed that the 14 Mission and 49 Mission/Van Ness are filthy, crime-ridden, and unreliable and so 1050 Valencia must have parking.

Unlike progressives, who also decry shortfalls with Muni but propose solutions, the Liberty Hill opponents offered only secession from public transit, insisting on driving in secure armored cocoons instead of addressing Muni reliability, and they also expect free or cheap parking in the public right of way.

You would think that progressives at the Board of Supervisors would see through this thinly veiled bigotry against the 14 and 49 buses. But instead, four self-professed progressive supervisors — John Avalos, David Campos, Jane Kim, and Eric Mar — voted against 1050 Valencia.

They may argue that they were more concerned about the neighboring Marsh Theater, which has concerns about construction noise (and also parking). The noise issue can be worked out, and why the progressive supervisors did not work this out in advance is a mystery. But if you watch the hearing closely, the Marsh basically opposed the development — period — and thus a modest car-free development that included affordable housing at an appropriate location. And so did four progressive supervisors. It’s baffling.

At the end of the day, 1050 Valencia moved forward, barely. But it can still be stopped at the upcoming Board of Appeals hearing. Meanwhile, it’s time for progressives to make a frontal response to the Muni-bashing coming out of Liberty Hill.

The SFMTA is offering a bold and ambitious proposal for these buses on Mission between 13th and Cesar Chavez. This includes a transit-only lane, restricting automobile traffic, rearranging loading zones, and removing curbside parking so that 46,000 daily 14 and 49 passengers have better reliability and less crowding.

This plan will make life easier for San Franciscans who rely on these buses, but will require progressive supervisors to openly and sincerely advocate for removal of on-street parking, to support SF Park, and push for car-free housing development in the Mission, rather than knee-jerk posturing for a few political points in future elections. Progressives, stop screwing around.

UPDATED: Board narrowly approves closing city parks at night

The San Francisco Board of Supervisors today narrowly approved Sup. Scott Wiener’s legislation to close parks and large plazas from midnight to 5am, a measure that Wiener said was about preventing vandalism but which progressive activists called an attack on the homeless.

The vote was 6-5, with Sups. John Avalos, London Breed, David Campos, Jane Kim, and Eric Mar voting against the proposal. The key swing votes in the decision were Breed — who wrote an op-ed for this week’s Guardian (posting soon) explaining her position — and Sup. Norman Yee, who was elected last year in Dist. 7 with progressive support.

To address the homeless issue, Kim asked for an amendment to make an exception for sleeping in the parks. Without the amendment, “we are criminalizing poverty and issuing fines people will never pay, and not getting the results we wanted,” she said. 

Hundreds of homeless lay their heads to rest in the parks of San Francisco every night as the city struggles to meet housing demand, which is already illegal under city law. Kim’s amendment says those sleeping in parks are to be cited under previously existing codes against sleeping in parks and not double-fined under this ordinance. Wiener supported the amendment and it was inserted into the legislation, although that didn’t end the debate over the legislation or win over its main opponents.

As the legislation was first introduced, Wiener made the argument he’s made many times before. Closing the parks at night is about vandalism, he said. 

“We need to establish a clear baseline that establishes hours for the park to combat vandalism and dumping,” Sup. Scott Wiener told the board. He made the case that most major cities in the U.S. have laws closing their parks and playgrounds at night, and that even New York City had them on the books.

Wiener also directly and flatly denied that his legislation was an attack on the homeless. 

“If the police wanted to remove people sleeping and camping in parks, they already have the tools to do that. This legislation does not give them those tools beyond what they have,” he said. 

But opponents of the measure, who have been organizing against it for weeks, said it will target the homeless and be selectively enforced. As Mar said at the hearing, “I think this is a really mean-spirited ordinance.”

And that’s when the avalanche of arguments began. Campos, Mar, Avalos, and Kim all  passionately defended the homeless that sleep in the parks. But no one brought more facts to the argument than Breed.

“We have 1,339 shelter beds and 6,000 people in San Francisco with nowhere to sleep,” she said. “I’ve been told again and again this will not target the homeless. But if it doesn’t target the homeless or the investment banker or the firefighter, who will this law target? Suspicious looking people in hoods? Teenagers?” 

The room took on a chill as she evoked echoes of Trayvon Martin and others who have been selectively targeted in the name of justice. Enforcement was her next bone of contention. There are only a handful of park police, often only two, that patrol over 220 parks in San Francisco, she said. 

If the ordinance is supposed to combat vandalism, it doesn’t even do that effectively, she said to the board: “We don’t have a legislative problem, we have an enforcement problem.”

To that end, Yee amended Wiener’s proposal to identify more funding for the park police. Everyone on all sides of the argument acknowledged that two to three officers to cover over 4,000 acres of San Francisco parks was woefully inadequate. 

It’s still unclear where that funding will come from, and how much it will be. 

After the meeting the Guardian asked Police Chief Greg Suhr, who was present for the meeting, if the homeless would be targeted under the ordinance.

“We’re not that Police Department,” he said. But he also said the controversial Sit/Lie Ordinance doesn’t target homeless people either, a claim that homeless advocates would dispute. “We’re a reasonable suspicion detention department.”

Tom Temprano, president of the Harvey Milk LGBT Democratic Club, disagreed. 

“I think that anyone who tells you the homeless will not be targeted in legislation that closes our parks at night are lying to you. There’s no other way to read this legislation,” he said. Temprano was one of the lead organizers of the sleep-in protest of the ordinance, which we previously covered.

When we asked if the ordinance would spur increased law enforcement in the parks, Suhr referred us elsewhere. 

“I leave the deployments to the station captains… certainly [the captains] have a pulse on what’s going on in the parks,” he said. 

So we called Captain Greg Corrales at Park Station, which oversees one of the most populous sections of Golden Gate Park, filled to the brim with campers. Corrales told us he didn’t imagine this ordinance would spur him to increase patrols or enforcement.

“There will not be more officers. The hours of the park have been posted on signs in the park, and past closing time people were cited for failure to abide by the signs,” he said. 

They cite 10-20 people for sleeping in the park per night, he said. As Kim noted, often these don’t lead to any prosecutions at all. 

But as for vandalism, Corrales said that there was recently a vandal throwing rocks through the windows of the Conservatory of Flowers and McLaren Lodge in Golden Gate Park. Would the ordinance help curb people from that kind of behavior?

“We’re already enforcing park closure,” he said. “It really doesn’t have much impact on us.” 

 

Red herring or not, park closure vote delayed while supes seek police input

There is only one police chief in this town, and no law regarding the usage of public parks shall pass without him. Or so they said yesterday when Sup. Scott Wiener continued for a week consideration by the Board of Supervisors of his controversial proposal to close the city’s parks and plazas at night.

Wiener – champion of the legislation that homeless advocates say specifically target the City’s homeless population — motioned for continuance on the hotly contested agenda item after Police Chief Greg Suhr was unavailable to discuss how the measure might be enforced. The motion was seconded by Sup. Malia Cohen and passed without objection. 

But the continuance request means that Wiener will have to deal with what he calls an “epidemic of vandalism” for another week as well. The legislation would amend the “Park Code to establish hours of operation for City parks from 5am to midnight, with certain exceptions; and make environmental findings.” 

“It’s long been illegal to sleep or camp in parks,” said Sup. Wiener. “[Police] don’t need another law.” 

“This. Is. About. Vandalism,” Recreation and Parks Department General Manager Phil Ginsburg told the Guardian. “The homeless won’t be thrown out. The laws are already on the books, man.”

And while Wiener and those in the RPD have continued their insistence that that the legislation was written explicitly to target late-night vandalism, illegal dumping, and other nefarious activities not related to homelessness, opposition to the legislation say it’s “red herring” legislation that, on its face, claims to combat vandalism, but underneath is actually a bill targeting the homeless.

Wiener disagrees with this stance, however, and actually called the argument made by the legislation’s opposition — that the bill is a “red herring” ostensibly aimed at vandalism, but that really targets the homeless — a “red herring” as well. A red herring, historically, is a distraction. It’s a Trojan Horse, a magician’s assistant, a tool designed to confuse and obfuscate actual information or intent. 

It is a term that first found a foothold in the hunting world, but made it’s transcendental leap into the world of politics. Politicians have employed the use of “red herrings” in the past. But why would a group called the Coalition on Homelessness actually support vandalism, as the supervisor’s “red herring” comments would suggest?

When this fact was pointed out, Wiener told the Guardian that he “wasn’t going to speculate.” (And neither will we, at least as to why the supervisor chose to use the phrase “red herring” to describe the COH’s argument in the first place.)

But regardless of rhetoric, next week’s vote promises to be close. COH Executive Director Jennifer Friedenbach told the Guardian last week that she had the support of the four most progressive supervisors — John Avalos, Jane Kim, David Campos and Eric Mar — and needed just two of the three swing votes to shoot down the legislation. Those three undecided votes rest in the hands of Sups. London Breed, Katy Tang and Norman Yee.

“This is going to be a close vote,” said Wiener.

But a vote that will have to wait a week.

The Coalition on Homelessness has launched a campaign to defeat Sup. Scott Wiener’s legislation to close down all city parks and most major plazas from midnight to 5am, which the Board of Supervisors is set to consider on Oct. 29. Activists are targeting three swing votes who could decide the controversial issue: Sups. London Breed, Norman Yee, and Katy Tang.

In an email blast to supporters, COH urged people to contact those three supervisors to raise their concerns, even suggesting a script that includes these arguments, “It further eliminates access to public space for all, it will displace homeless people, and is a waste of city funds.” [UPDATE: To protest the proposal, the Harvey Milk LGBT Democratic Club is hosting a “sleep-in” protest at Dolores Park tonight (Mon/28) starting at 9pm.]

COH Executive Director Jennifer Friedenbach told the Guardian that she has the support of the four most progressive supervisors — John Avalos, David Campos, Jane Kim, and Eric Mar — and that she just needs two of the three swing votes that COH is targeting to kill the measure outright and avoid the kind of compromise that has become Board President David Chiu’s specialty this year.

She said the measure would be particularly harmful to the homeless LGBT community and other vulnerable populations that seek refuge at night in Golden Gate Park and other hidden spots, but that it’s bad for everyone. “It forces them out into the storefronts and streets and neighborhoods and nobody will be happy with that,” she said.

Wiener denies that the measure is aimed at the homeless, telling the Guardian that his intent is to address graffiti, illegal dumping, and damage done to park facilities overnight. “We’ve had an epidemic of vandalism in our parks and it’s getting worse,” Wiener told us. “It’s a significant problem and it absolutely degrades people’s ability to use the parks.”

Friedenbach said she appreciates that Wiener isn’t aiming his rhetoric at the homeless, even though she said that’s who will be most effected by it.

“It’s great in terms of not bashing homeless people, but we know every time something like this comes up, it increases public anger toward homeless people,” she told. And she notes that the measure is being trumpeted by people who do want to use it to go after the homeless, including Mayor Ed Lee, who went off script last month and told the Examiner that he hopes the measure will be a tool to clear the homeless from Golden Gate Park.

“The mayor said it was a great idea because we need to get the homeless people out of the park,” Friedenbach told us, noting also that, “Wiener has had a thing of going after homeless people.”

Wiener denies that this is about the homeless, and he responded to Lee’s comments by telling us, “I can’t speak for anyone else.” He also said that it’s already illegal to sleep in the parks and “to the extent the police want to do sweeps in the parks, they can already do so.”

The measure would apply the closing hours to all property controlled by the Recreation and Parks Department, which includes every city park and the city’s largest plazas, including Civic Center Plaza, Justin Herman Plaza, and Union Square.

“One thing people don’t think about is this also applies to the plazas,” Friedenbach told us. “A lot of our plazas are hangout spots late at night, and there’s no reason they shouldn’t be.”

Wiener said that small plazas, such as Harvey Milk and Jane Warner plazas in the Castro, aren’t under RPD jurisdiction and therefore aren’t effected by his legislation. And he said the ordinance was already modified to allow people to walk through the affected plazas without stopping, and that he’s open to further amendments.
