The odd evictions at Parkmerced

The San Francisco City Attorney’s Office has started investigating conditions at Parkmerced in the wake of housing advocates’ concerns that tenants have been issued a high volume of notices warning that they could face eviction due to unpaid utility fees.

The questions surrounding back payments and pending evictions, many of which impact low-income renters, have emerged only a few months after the Board of Supervisors narrowly approved a controversial redevelopment project at the neighborhood-scale housing complex. When it was under consideration, project opponents voiced concerns that housing for low-income residents could be jeopardized under the plan if tenant protections guaranteed by the developers did not stand up in court.

“The timing of it is a little suspicious,” said Tyler McMillan, executive director of the San Francisco-based Eviction Defense Collaborative. “A lot of folks suddenly are moving toward the eviction process … right after they got approved for this big development. It all just smells really bad.”

Parkmerced spokesperson PJ Johnston told the Guardian the notices had nothing to do with the development approval, and were simply a consequence of unpaid bills. “I don’t think the city attorney is going to find anything of particular interest,” he said. “This is an issue of a property owner telling people who owe bills that they have to pay their bills.”

Stellar Management, Parkmerced’s property management company, issued 196 notices this past summer and in September warning tenants that they could face eviction if they did not take steps to bring their accounts current within three days.

In some cases, back payments had piled up for more than a year, and the bills ranged from around $400 to $1,200 — a burdensome dilemma for very low income residents getting by on fixed incomes.

The issue wasn’t payment of rent; most of the charges stemmed from water, sewer, and trash pick-up fees administered by a third-party billing company called American Utility Management (AUM). Parkmerced cited breach of the lease agreement as grounds for eviction.

Some tenants dispute the charges, and have told the San Francisco Rent Board and other agencies that they were surprised to receive the bills and didn’t know they had past-due amounts until they were presented with the high bills.

In any case, it’s an unusual situation — San Francisco tenants rarely face eviction over water or garbage bills.

 

A HUGE GROUNDSWELL

Many tenants have since been given a chance to set up payment plans and were granted a 45-day timeline to work out a payback system, noted San Francisco Rent Board director Delene Wolf. But not everyone was lucky enough to dodge the bullet. Since the notices went out, the Eviction Defense Collaborative has taken on cases for 14 separate eviction proceedings at Parkmerced, McMillan said.

“They are evicting a lot more people in the last couple months than they were at this time last year,” McMillan noted. Wolf confirmed this, saying, “We saw a huge groundswell.”

The city attorney has been responsive to advocates’ concerns. “We met with the City Attorney’s office, and they’re collecting cases,” explained Sara Shortt, executive director of the Housing Rights Committee. “A key question is, why are these low-income renters behind?”

So far, the answer remains unclear. Tenant advocates remain skeptical that the charges are legitimate, in part because they have questions about how fees were assessed. There have also reports of monthly parking fees charged to tenants who don’t own vehicles. “They’re really questionable amounts … that are years and years old,” McMillan noted. “There’s so much doubt about whether they owe this money.”

Some of the 196 tenants who received warning notices claimed they didn’t know they were responsible for the fees. John Martinek tried to help his friend, a 55-year-old Parkmerced resident and veteran, after he was hit with a bill totaling more than $600.

“He might’ve owed it, but here’s the thing: They never told him anything about paying water and garbage,” Martinek said. “They never once asked him, they never once said a word. They were trying to scare him, there’s no question about it. They were trying shake him out of there.” He said his friend had been spared from eviction thanks to legal assistance.

Johnston, meanwhile, dismissed the idea that tenants were in the dark on how much they owed. “It’s patently ridiculous to suggest that residents who have signed a lease weren’t aware that they had to pay their bills,” he said.

In most cases, garbage charges in San Francisco are either included in the rent or are completely separate from rent, collected by a private company and can’t be grounds for eviction. Water bills are typically included in monthly rent or collected by the city — and thus aren’t grounds for eviction either.

 

WHERE IS DAVID CHIU?

Of the 14 eviction proceedings that are going forward, McMillan said, 10 involve tenants who receive Section 8 housing assistance, a federal program administered by the San Francisco Housing Authority. Of those 10, eight concerned disputed fees, he said.

There are a total of 170 Section 8 tenants at Parkmerced, according to figures cited by Megan Baker of Catholic Charities CYO, and 82 of them were among the 196 tenants who received three-day notices.

While Parkmerced previously attracted renters enrolled in the Section 8 program, Stellar stopped accepting those housing applications about a year ago, Baker said. Her organization provides emergency financial assistance for families at risk of homelessness and has been working with Parkmerced tenants since October 2009.

Baker added that she’d met with some tenants who were charged attorney’s fees on top of the back-payments. “They don’t have the means to pay legal costs,” she said. “These very large charges are not going hand-in-hand with their monthly statements. It’s all of a sudden. It leads us to think that in the process of changing management and gearing up for redevelopment, they really don’t want low-income tenants.”

In the wake of recent coverage about the trend of eviction notices in the Guardian and other publications (See “Low Income Tenants Face Possible Eviction at Parkmerced,” Politics Blog, Oct. 7, 2011), the three-day notices have slowed, reports Wolf, of the Rent Board. “There were no notices this month,” she said, referring to October, which could be a sign that management had taken a different tack under pressure from housing advocates and media scrutiny.

Shortt, of the Housing Rights Committee, noted that she had sought assistance from Board President David Chiu after her organization began working with impacted tenants. Chiu cast the swing vote on Parkmerced, sparking the ire of tenant advocates, but professed to be looking out for tenant interests.

Chiu introduced 14 pages of amendments to the Parkmerced development agreement intended to strengthen tenant protections, and used those changes to justify his support for the project. However, the Sunshine Ordinance Task Force determined Nov. 1 that members of the Land Use and Economic Development Committee violated the San Francisco Sunshine Ordinance when it considered Chiu’s amendments, because the public wasn’t provided with full documentation of the proposed changes.

Chiu’s office contacted Parkmerced with questions about the eviction notices, but Shortt said she came away with the impression that the board president was not about to exert pressure on Stellar Management or Parkmerced developers over this issue. Chiu’s office indicated to Shortt that they planned to collaborate with Sup. Sean Elsbernd, whose District 11 includes Parkmerced, to decide how to proceed.

“We haven’t seen any evidence that this is connected to the development in any way,” Judson True, Chiu’s legislative aide, told the Guardian. “We’re committed to working with Parkmerced, Sup. Elsbernd’s office, and the residents to keep as many people in their homes as possible.”

The San Francisco City Attorney’s office is urging any Parkmerced tenants experiencing questionable late-payment charges to contact the Code Enforcement Hotline at 415-554-3977.

The bad old days

Willie L. Brown, according to the Chronicle’s John Cote, is “a tremendously popular figure in the city, viewed by many as an avuncular man-about-town, elder statesman and a uniquely San Franciscan character.” The Ed Lee Story, a hagiographic campaign book, refers to Brown’s “characteristic showmanship and hypnotic charm.” Even Randy Shaw, the housing activist who clashed with Brown over gentrification once upon a time, now says in BeyondChron that Brown’s first term “was the most progressive of any mayor in modern San Francisco history.”

I feel as if I’m living in some sort of strange parallel universe, something out of Orwell or North Korea or the Soviet Union of the 1950s. It’s as if history never happened, as if the years between 1996 and 2004 have just vanished, have been deleted from San Francisco’s collective memory. It’s crazy.

I wonder:

What about the thousands and thousands of people who lost their homes and were tossed out of the city like refugees from a war? What about the rampant corruption at City Hall? What about the legions of unqualified political cronies who got good jobs and commission posts? What about the iron-fisted machine rule that kept local politics closed to all but the loyal insiders? Doesn’t any of that count?

Here are some things that absolutely, undeniable, demonstrably happened while Willie Brown was mayor:

Rents on the East Side of town, particularly in the Mission, tripled and sometimes quadrupled between 1996, when Brown took office, and 2004, when he left. Evictions more than tripled, too, and at one point more than 100 people a month were losing their homes. Most of those people were low-income, long-term tenants. They were forced out because richer people were moving into town during the dot-com boom and could pay more for those apartments. We called it the “Economic Cleansing of San Francisco.”

Every day, it seemed, we’d be out at another rally as the Tenants Union and the Mission Antidisplacement Coalition tried to save another family from the forces of gentrification. Every week, it seemed, another group house full of artists would be served an eviction notice. Everywhere you looked, nonprofits and small businesses were losing space to high-tech companies with plenty of money.

I watched the wrecking crew tear down a studio complex on Bryant Street, forcing more than 100 painters and photographers to leave, to make way for a high-tech office project that was approved even though it violated the local zoning laws — and then was never built. For two years, I walked to get my lunch past the empty hole in the ground that had once been a thriving community.

That was typical. Every developer who waved money in front of the mayor got a building permit, no matter how crazy, illogical or illegal the project was. The Planning Department and the Bureau of Building Inspection were little more than fronts for the lobbyists and Brown cronies who determined development policy in the city.

In October, 1999, the author Paulina Borsook wrote a famous piece in Salon called “How the Internet Ruined San Francisco.” I agreed with the sentiment; the influx of the dot-commers was wrecking all that was cool and weird about the city. But she got one point wrong: The Internet didn’t ruin anything. The Internet was, and is, a technology, a tool, something that, like most technological advances, can be used for good or evil.

Mayor Brown didn’t create the dot-com boom. Although he took credit for an awful lot of things, even Willie didn’t claim to have invented the Internet.

But what he did — and what ruined many San Francisco neighborhoods, and ruined the lives of many San Franciscans — was to let the economic cleansing of the city happen, without raising a finger to slow it down or prevent the evictions or protect the most vulnerable people in the city. Over and over, he encouraged it — by appointing commissioners and supervisors and department heads who allowed evictions and development and displacement in the name of growth and prosperity.

In fact, when reporters from the zine Maximum Rock ‘n’ Roll asked Brown about the problems facing poor people, he told them that the city had become so expensive that poor people would be better off living somewhere else.

Because he didn’t care about poor people, or tenants, or artists, or anyone who lacked money and flash and dazzle and clout. He was the worst kind of imperial mayor.

Here’s how we put in it in our 33rd anniversary issue in 1998:

“Let’s say the next major earthquake that hits San Francisco is of roughly the same magnitude of the Loma Prieta quake of 1989, or maybe just a bit stronger. Let’s say it wipes out right 1,000 houses and leave some 5,000 people homeless … and lets say a few unscrupulous profiteers take advantage of the shortages of critical supplies and charge desperate residents triple the normal rate for food, blankets and drinking water….

“The profiteers, speculators and charlatans would be exposed in the press and roundly, loudly denounced by every political and community leader in the city. The ones who didn’t wind up in jail would be forced to leave town in disgrace.”

Or else they wouldn’t. Because when an economic earthquake ravaged San Francisco during his term, Brown — the most powerful mayor in modern history, a guy who could have had an immense impact on what was happening — went to meet the speculators and profiteers with outstretched arms, welcomed them to the city and partied with them at night.

And when he ran for re-election, they thanked him by funding an astonishing $5 million campaign.

Then there was the corruption. Not only did Brown raise pay-to-play to a new art form, he filled the city payroll and key commissions with campaign workers, former political allies, and cronies, subverting the civil service system and undermining both the function of city agencies and public respect for local government. At least seven Brown appointees were indicted or investigated for criminal misconduct. While sentencing a Housing Authority official to five years in prison, U.S. District Judge Charles Legge decried what he called Third World-style corruption at San Francisco City Hall.

When Mayor Ed Lee, who is now seeking a full four-year term, was asked to give Brown a grade for his eight years in Room 200, Lee said: A-Plus.

Which makes us a little nervous. To say the least.

I’ve been going back through the Guardian archives over the past couple of weeks, picking out some great covers to reproduce (see page 18) and looking at four and a half decades of alternative news coverage of San Francisco. And if there’s one theme that emerges from the stacks and stacks and stacks of papers, it’s that local government matters.

In the 1960s, when the underground press was talking about sex, drugs and dropping out, the Guardian was talking about the ways big corporations were stealing the taxpayers’ money at City Hall. (Okay, the Guardian wrote about sex and drugs too. But sex and drugs and political scandals.)

The difference between the independent alternative press and the underground papers of the era was more than just thematic. The underground publishers were having a great time and celebrating culture, but none of those publications was built to last. From the day they published their first issue in October, 1966, Guardian founders Bruce Brugmann and Jean Dibble intended their paper to become a permanent part of San Francisco.

The Guardian quickly demonstrated that it had a different approach than a lot of the “New Left” — particularly when it came to electoral politics. At a time when some were saying that it made no difference whether Ronald Reagan or Pat Brown won the 1966 governor’s race, the Guardian made the key point about Reagan.

“California cannot afford the luxury of this kind of conservatism,” a Nov. 7, 1966 editorial stated. “Because of the millions of people coming to California, because San Francisco and Los Angeles soon will have the greatest concentration of urban power in history, because farm land and open space is vanishing at a suicidal rate, because technology is putting vast populations out of work, because of the social neglect of our cities and the uglification of our countryside, because we now have the knowledge to bridge the gap between the rich and the poor.”

And while the paper devoted considerable space to reporting on and opposing the war in Vietnam, it was also developing a reputation for local investigative reporting. One June 7, 1971 story showed how the city had all of its short-term deposits in local banks that paid no interest at all. The story parked an investigation by the city’s budget analyst, the resignation of the city treasurer — and a new investment policy that brought the city at least $1 million more revenue a year. (Adjusted for inflation, that’s about $5 million a year, times 40 years is a lot of money that the Guardian brought into the city coffers).

And from the start, the Guardian was a nonpartisan, independent foe of corruption, secrecy and undue influence at City Hall. So while the paper eagerly endorsed Phil Burton (and later his brother, John) for Congress and lauded their antiwar and environmental policies, the Guardian also blasted the Burtons for exercising undue influence back home. The paper strongly endorsed George Moscone for mayor — then denounced him when he fired Harvey Milk from a commission post after Milk had the gall to challenge the Moscone/Burton candidate for state Assembly.

The 1999 Sunshine Ordinance, which dramatically opened up City Hall records, was sponsored and promoted by the Guardian. Willie Brown and his cronies hated it.

It’s probably a misnomer to say that the Burtons, who were a dominant force in local politics in the 1970s and 1980s, ran an old-fashioned machine. They didn’t have the iron control over local politics and the patronage jobs system that the word “machine” implies.

But when Brown became mayor of San Francisco, he had all of that. Brown controlled eight solid votes on the Board of Supervisors (and through various political machinations, had managed to appoint most of them). “He ruled the building,” Assemblymember Tom Ammiano, who was a supervisor during those years, recalled. “If you defied him, you were radioactive.”

And one of the people who rose through the ranks as a loyal Brown appointee was Ed Lee. Who to this day thinks things in that administration were just dandy.

 

The Lee campaign complains about “guilt by association,” and that’s a legitimate point. Ed Lee isn’t Willie Brown. He’s a lot more open, a lot (a lot) more humble, and as numerous progressives have pointed out to us, his door is open. He doesn’t have the history of sleaze that pretty much defined Brown’s political career.

There will be no “Ed Lee Machine.” In fact, with district elections of supervisors pretty much guaranteeing more diffuse political power in the city, there will never be another mayor able to rule the way Brown did.

And these days, Brown’s clout could easily be overstated. Until he engineered the selection of Ed Lee as mayor, his power seemed to be waning. And even Mayor Lee hasn’t done everything that Brown wanted.

Of course, the Chronicle, which he helped immensely when Hearst Corp. bought the paper and had trouble with federal regulators, has helped Brown by giving him a column that created a new, sanitized persona.

But the important thing about the Brown administration was not so much who was in charge but who benefited. The landlords, the developers, the big corporations got pretty much what they wanted from City Hall. The rest of us got screwed.

And now those same interests — in some cases, the exact same people — who supported, promoted and worked with Willie Brown are backing Lee for mayor. If they thought he was going to be an independent progressive, that money and support wouldn’t be coming in. There are people who miss the machine days — and if they think Ed Lee is their guy, it’s reason to worry.

Corruption matters. When people lose faith in local government because they see the kind of sleaze that was daily business under Brown, then they stop wanting to pay taxes for public services. After all, the mayor is wasting our money already. Lee may be a decent guy — but some of the people he hangs out with, some of the people who are supporting him, have a long and very unpleasant history in this town. And all the time he was sitting there at City Hall, while Brown was running a corrupt operation that did lasting damage, Lee never raised a public finger in protest. I hate to see all the history forgotten when people decide who to support for mayor in November, 2011.

Low-income tenants face possible eviction at Parkmerced

At least nine eviction proceedings have started at the Parkmerced housing complex, the site of a controversial new housing development, in response to an effort by the property management company to collect back payments on rent and utility bills, the Guardian has learned.

In recent months, nearly 200 residents received official notices warning that they would face eviction if they did not take steps to bring their accounts current within three days, according to Sara Shortt, executive director of the Housing Rights Committee of San Francisco. About 80 three-day notices were issued to tenants who are on Section 8, a federal low-income housing assistance program that subsidizes rental payments using public funds provided by the local housing authority.

“They’re extremely low-income renters, and they’re suddenly being asked to pay large balances,” Shortt explained. “It’s blood from a turnip.” Most of the amounts owed ranged between $600 and $800, she added.

Shortt said that while some tenants were being allowed to set up payment plans, this measure wasn’t guaranteed for every tenant attempting to address the problem within the three-day timeframe. And she was skeptical that the payment-plan arrangements being presented by management were realistic in every case.

“I don’t know if Parkmerced is doing anything illegal,” Shortt said, acknowledging that she was receiving conflicting accounts of the situation. “But they’re executing something about legitimate recovery of money in an unfair manner. To allow people to slide for years and suddenly come at them for back bills is a one-way ticket for eviction.”

The Guardian was unable to reach Stellar Management, the real-estate management company at Parkmerced, but Shortt said she had spoken with Stellar representatives on behalf of tenants who were contacting the Housing Rights Committee in a panic.

Stellar representative Bryce Boddie explained the situation to her by saying a previous property management company had left billing records in disarray, and the company was finally getting around to straightening out its books by demanding payments that had long since been owed. “Their contention was that they basically decided it was time to clean house and recoup payments,” she said. Shortt said she’d also been told that Stellar had come under pressure from Fortress Investment Group, a firm that took ownership of the property last year, to get payments in order.

But P.J. Johnston, a public relations representative for Parkmerced, rejected that account, saying, “We absolutely follow up with residents who are not paying their bills.” Johnston said the number of three-day notices served this year were in keeping with last year, indicating that there had been no drastic changes in policy since the approval of the new housing project. He did not know how many Section 8 tenants received the warning notices in 2010. “Whether someone is a Section 8 certificate holder or just a regular resident, everybody’s got to pay their rent,” he said.

Johnston bristled at the criticism that renters were being asked to fork over unrealistically high sums on the spot for payments that had lapsed for long periods, saying, “If we had moved swiftly to evict residents sooner, we’d be hearing that we didn’t give them a chance.”

The issue comes on the heels of Board of Supervisors approval for a controversial housing development project at Parkmerced that tenant groups opposed because they felt it didn’t go far enough to protect renters. A development agreement negotiated between Parkmerced Investors and the city guarantees that rent-controlled tenants will be able to move into brand-new units at the same rent-controlled rate once the old units are demolished. Some residents are suspicious that management’s decision to issue three-day notices and take steps to evict tenants who cannot pay is a strategy for skirting these requirements.

Shortt said she couldn’t be sure that this was the case, but worried nevertheless that low-income tenants could wind up being tossed out of Parkmerced, which is just the scenario that tenant advocates had feared. “The end result really is in clear conflict with the spirit of negotiations and tenant protections,” she said.

Unemployed construction workers protested outside UC Mission Bay’s Hospital building for the third day straight—but by early afternoon seemed to have got some clarification from UC officials over upcoming job opportunties at the site.


At issue is the tension between UCSF’s stated desire to be a good neighbor and put local residents to work, and the reality that while unemployment remains high throughout the construction industry, the communities immediately neighboring UC’s Mission Bay campus have been hard hit.


.“I want them to set up a system where we have a referral mechanism that includes CityBuild, and for UC to discontinue using DPR’s subcontractor Cambridge and other consultants,” James Richards, President of Aboriginal Blackmen United (ABU), said shortly before he met with UC officials. “Because if you don’t have a community-based organization helping UC make good on its commitment to be a good neighbor, then you are going to see stuff like UC’s voluntary local hire system. The idea that you can have a voluntary system without someone like ABU, which organizes folks from the community, is why this system is going to fail. And it’s why we only see token folks on the site. Because if you don’t work with the community, you won’t get the community to work. Really it’s an easy proposition: you have unemployed union workers at the gate. So put them to work.”

Just then Dwayne Jones, who worked in the Mayor’s Office when Gavin Newsom occupied Room 200, stopped by to chat with Richards and the ABU crew. 
Jones, who is now with Platinum Advisors, told the Guardian that he works as consultant for DPR Construction, UC’s prime contractor at Mission Bay. Fortune recently ranked DPR number 22 in its list of Top 100 companies to work for in the U. S.


Jones noted that his work with DPR had nothing to do with ABU’s local hire protest. “I’m only involved because I have worked with all these folks in the past and know all the players,” Jones said. “So, I’m helping these folks. At the end of the day, DPR’s concerns and mine are the same: I want to facilitate a process that maximizes opportunities for local folks.”

“These are all great people,” Jones continued. “I’ve worked for them for 15 years.”

Asked what the city can do to get the state-owned UC to hire more folks from economically disadvantaged communities on a project that isn’t financed by city funds, Jones said, “I agree that there is little leverage that the city has, given the constraints of the contract, so people need to be creative.”

Jones said he was not aware that Dr.Arelious Walker and the San Francisco Workforce Collaborative has issued a flier stating that they were gathering lists of names to be submitted to UC for jobs, amove that angered ABU members since they have been protesting for jobs at the site for over a year


“I was not aware of this group but there are a multitude of organizations trying to do good work,” Jones said. “And frankly this [multitude] was one of the things that led to the end of the lead agency methodology, because it caused so much division in the community. I hope we build a really strong coalition in the community that leverages its strengths.”

“I’m glad that they accepted the initial recommendation to do whatever they can to mirror the city’s local hire legislation,” he said. “Because although it’s voluntary, if it’s part of your culture and you embrace it, it’ll get done. And these are the people who have been out here for a year.”

Last December, the Board approved local hire legislation for city-funded projects. Mayor Gavin Newsom did not sign the legislation, which met stiff opposition from the building trades, and it’s fallen to Mayor Ed Lee to mplement this new law, which does not apply to state agencies,but had led to a parallel dialogue with UC.


“Much like any policy, implementation is the biggest challenge,” Jones observed. And until we do some inventory of which organizations, contractors, individuals and groups can do each piece of the work, it’s going to be a struggle. What I’m praying for is that local hire legislation allows us to get a bigger table. What I’m interested in doing is creating a pipeline of qualified workers, so that whenever something like this happens, I don’t have to hear the excuse that folks aren’t ready to work.”

Then Richards took off for a meeting with UC Vice Chancellor Barbara French that lasted two hours during which time rumors started circulated that Mayor Ed Lee had called French to try and help move the conversation along, as ABU members continued their protest and shared stories with reporters of how they came to be standing on a picket line in Mission Bay.

One worker, who preferred to remain anonymous, said he was frustrated by UCSF’s plea for workers to remain patient because jobs are coming soon. “We’ve been out here for one and a half years, so since before they did their demolition, and they have been playing games with us,” he said. “ Folks with ABU were promised jobs. But then they didn’t get anything. That’s what UC does. They try to pacify you and tell you stories, then the money gets taken out of the community, and another year goes by. So, if anybody says, why aren’t you more patient, the answer is that the whole area has been built with only a handful of people from our community. Especially now, when no one has jobs, and everybody wants to work here. We are not going into other communities and trying to steal their jobs. We just want to work here. But we could be protesting every day, until this whole stuff has been built. It’s a city within a city. Just look around you. We was patient. And all this stuff has been built and we got no jobs.”

Michelle Carrington, 58, a flagger and an operating engineer from the Bayview, said Dwayne Jones helped her graduate from Young Community Developers. “He got me in tears, he dropped me in the mud at 5 in the morning and made me do push ups, but I fought and kept on and graduated at the top of my class out of three women and 15 men,” she said. “But now we got people going behind the gate, folks who used to work for Dwayne Jones, like Dr. Arelious Walker, who are trying to say that they are the ones who have got the sign-up list for jobs here. But you ain’t been here marching, or down at City Hall fighting for local hire. And I saw Rodney Hampton Jr. on the number 54 bus, and I let him have it. I said, what’s this I heard about you and Walker? And he said he went to UCSF and tried to get a bid but was told ABU had it. So the only way to get in was for him and Marcellus Prentice to go to God’s house.  But Walker’s not out here. Meanwhile, we see folks coming from Hayward, Sacramento and Vallejo and working on this yard. Why is it such a hard decision to try and put us to work? It’s easy. Just take 5 or 10 of us, put us to work, and we will go away. Work smarter, not harder.

Laborer Sharon Brewer, who was born and raised in the Bayview and has been out of work for two years. She helped her granddaughter, Akira Armstrong, hold a protest sign and talked about losing her apartment because she lost her job.
“I had to move back in with my daughter because nobody lets you live for free,” she said. “I used to work for UCSF as a patient coordinator for physical therapy but I got laid off. Now I have to dummy down my resume to try and get a job making $8 an hour selling coffee and donuts .”

Jesse Holford said he had reached the fourth level of his apprenticeship as a Carpenter.
‘There are eight levels between an apprentice and a journeyman,” he said.

Jason Young and Alonzo McClanahan said they were unemployed laborers from  Bayview Hunters Point resident. Robert English, a carpenter journeyman from the Bayview, had been out of work 6 months. Tina Howards, a carpenter’s apprentice from the Bayview with four kids,  had been out of work for a year. And Keith Williams, a carpenter from the Bayview, had been out of work for nine months.


Fred Green, who has lived in the Bayview for 50 years and has five kids, said protesters were trying to remain as peaceful as possible.


“But an empty belly makes you do strange things,” Green said. “If there’s enough work for everybody, why should we be stuck at home while someone comes into my community and takes food out of my kids’ mouths. I got five kids and they all go hungry.”

Bayview resident Carlos Rodriguez has three kids and has been out of work for two years.
“They called me to work before Christmas but never hired me, “ he said.


Bayview resident Truenetta Webb has two kids and has been out of work for four months.
‘Some guys called me and took my information, but there’s been no work,” she said.

Troy Moor, who has lived in the Bayview for 47 years and has two kids, worked in January on Lennar’s shipyard development for 17 days.


“Two weeks ago, UC said they were going to hire four folks on ABU’s list, but they didn’t,” he said. “We don’t want it to get ugly out here. All we want to do is feed our families.”

Moor said he believes Mayor Ed Lee will ensure local hire is implemented on city-funded projects. “Ed don’t want no problem, we know him personally, we used to work for him when he was at DPW (the city’s Department of Public Works),” he said. “He’s a decent guy, as long as you keep the pressure on him.”

Moor speculated that if ABU blocked both gates to the UC Mission Bay hospital project, it would cost UC thousands of dollars.“Here at the front gates, we are visible, but we figure that if by next week, nothing is happening, we’ll start making them lose money,” he said.

Ed Albert, a retired painter and a Bayview resident for 57 years, said he was protesting for folks in his community.
“I grew up in the Bayview, I’m a servant of the Bayview,” he said. “I went from paperboy to contractor. I was a painter for Redevelopment and the San Francisco Housing Authority. But I don’t want a job. Who’d hire a 67-year-old guy with one eye? But I want to see my people get a job.”

James Amerson, a laborer with Local 261, said he worked on the Transbay Terminal in July, then got transferred to Pier 17.
“But when that was over, they didn’t bring me back to the Transbay, so I’ve been out of work since the end of December,” Amerson said. “They sent me to the Transbay as a flagger, and I rode by the other day, and saw they had an apprentice operator doing flagging.”


“When we are not working, we always come back to James [Richards]’s church at Double Rock,” he continued. “We meet at 9 a.m., Monday through Thursday. James is sick with diabetes. But he ain’t asking for anything. He’s here for the people, coming out here, buying food every day. We feed everybody. Yesterday he was feeding the police officers.”

Finally, Richards emerged from his meeting with UC officials. After he crossed 16th Street slowly, Richards was encouraged take a swig of orange juice from the back of ABU’s flatbed truck before giving folks an update.


“When DPR needs someone for a job, they’re gonna call Dwayne Jones, and then Dwayne will let us know,” Richards finally said. “There’s enough work for everybody. There’s hundreds of jobs, but I don’t know if they are in every trade. So, I feel good. But not so good that I can say that ten carpenters will be hired tomorrow. There’s not enough need for that, right now. But the work that’s there, when they call, you’re going to know it. Laborers, there are going to be no others going first. You guys are going first. So, I suppose next week, more laborers should be going, then more carpenters.”

Asked if ABU was going to continue its protest, Richards ‘said he thought folks needed to regroup.


“I think we got enough to not have to come out here tomorrow again. So, we’ll come back to church on Monday and let everyone know what happened. Then we’ll make a decision about what we are going to do. If the majority says, fuck this man, make ‘em hire 10 or 20 more folks, then that’s what we’ll do. But for now, we gotta regroup.”

Reached by phone, as ABU members prepared to pack up for the day, Cindy Lima, executive director of UC Mission Bay Hospitals Project, said she felt UC’s meeting with Richards was positive


“We clarified some misunderstandings and made some progress,” Lima said. “Our goal is still to create jobs for San Francisco residents and make this project happen. So, we are continuing to try and match people who need to go to work with available job opportunities. The bottom line is that there are a lot of people in this city who are out of work and a lot of groups with different intentions in mind and we get tangled in that process. So, maybe we need to have more dialogue about when jobs will become available. And we have made a commitment to talk more.”










They have issues: Members of the new Board speak

Board President David Chiu touched off a broad political discussion in recent weeks with his statement that officials were elected “not to take positions, but to get things done.” Delivered just before his reelection as Board President with the solid backing of the board’s moderate faction, Chiu’s comment has been viewed in light of City Hall’s shifting political dynamic, a subject the Guardian explores in a Jan. 19 cover story. Politics aside, Chiu’s statement also begs the question: Just what do members of the board hope to get done, and how do they propose to accomplish the items on their agenda?
Last week, Guardian reporters tracked down every member of the board to find out. We asked, what are your top priorities? And how do you plan to achieve them? Some spoke with us for 25 minutes, and others spoke for just 5 minutes, but the result offers some insight into what’s on their radar. Not surprisingly, getting the budget right was mentioned by virtually everyone as a top priority, but there are sharp differences in opinion in terms of how to do that. Several supervisors, particularly those in the moderate wing, mentioned ballooning pension and healthcare costs. Aiding small business also emerged as a priority shared by multiple board members.

District 1

Elected in 2008 to represent D1, Sup. Eric Mar has been named chair of the powerful Land Use & Economic Development Committee and vice chair of the City Operations and Neighborhood Services Committee.

Asked to name his top priorities, Mar said, “A humane budget that protects the safety net and services to the must vulnerable people in San Francisco is kind of the critical, top priority.”

It’s bound to be difficult, he added. “That’s why I wish it could have been a progressive that was chairing the budget process. Now, we have to work with Carmen Chu to ensure that it’s a fair, transparent process.”

A second issue hovering near the top of Mar’s agenda is lending a helping hand to the small businesses of the Richmond District. “There’s a lot of anxiety about the economic climate for small business. We’re trying to work closely with some of the merchant associations and come up with ideas on how the city government can be more supportive,” he said. Mar also spoke about the need to respond to the threat of big box stores, such as PetCo, that could move in and harm neighborhood merchants. “I’m worried about too many of the big box stores trying to come in with an urban strategy and saying that they’re different — but they sure have an unfair advantage,” he noted.

Programs and services for the senior population ranked high on his list. Mar noted that he’d been working with senior groups on how to respond to a budget analyst’s report showing a ballooning need for housing – especially affordable housing – for seniors. “It’s moving from the Baby Boom generation to the Senior Boomers, and I think the population, if I’m not mistaken, by 2020 it’s going up 50 percent,” he said. “It’s a huge booming population that I don’t think we’re ready to address.”

Addressing food security issues through the Food Security Task Force also ranked high on Mar’s list, and he noted that he’s been working with a coalition that includes UCSF and the Department of Public Health to study the problem. “We’ve had a number of strategy meetings already, but we’re trying to launch different efforts to create healthier food access in many of our lowest income neighborhoods,” Mar said.

Finally, Mar talked about issues relating to the park. “I do represent the district that has Golden Gate Park, so I’m often busy with efforts to preserve the park, prevent privatization, and ensure enjoyment for the many residents not just in the Richmond but throughout the city that enjoy the park.” Although it’s not technically in his district, Mar noted that he is very supportive of HANC Recycling Center – and plans to advocate on their behalf to Mayor Lee.

Sup. Mark Farrell
District 2

Elected to replace termed-out D2 Sup. Michela Alioto-Pier, Farrell has been named vice-chair of the Government Audits & Oversight Committee and a member of the Rules Committee. A native of D2, Farrell told the Guardian he believes his roots in the city and background as a venture capitalist would be an asset to the city’s legislative body. “I know at the last board, Carmen [Chu] was the only one who had any finance background,” he said. “To have someone come from the private sector with a business / finance background, I really do believe … adds to the dialogue and the discussion here at City Hall.”

Along those lines, Farrell said one of his top priorities is the budget. “I’m not on the budget and finance committee this time around, but given my background, I am going to play a role in that,” he said.

So what’s his plan for closing the budget deficit? In response, he alluded to slashing services. “In the past, there have been views that we as a city don’t provide enough services and we need to raise revenues to provide more, or the perspective that we first need to live within our means and then provide more services. Everyone’s going to disagree, but I’m in the latter camp,” he said. “I do believe we need to make some tough choices right now – whether it be head count, or whether it be looking at …pension reform. I do believe pension reform needs to be part of the dialogue. Unfortunately, it’s unsustainable.”

He also said he wanted to be part of “trying to create and focus on a framework for a long-term financial plan here in San Francisco.”

Secondly, Farrell discussed wanting to put together a “jobs bill.”

“Jobs is a big deal,” he said. “It’s something I want to focus on. There are only so many levers we can pull as a city. I think the biotech tax credits have spurred a lot of business down in Mission Bay.”

Next on Farrell’s agenda was quality-of-life issues, but rather than talk about enforcing San Francisco’s sit/lie ordinance – supported by political forces who organized under the banner of maintaining ‘quality-of-life’ – Farrell revealed that he is incensed about parking meter fines. “It is so strikingly unjust when you are 1 minute late to your parking meter and you have a $65 parking fine,” he said.

Farrell also mentioned development projects that would surely require time and attention. “CPMC is going to be a major dominant issue,” he said. He also mentioned Doyle Drive, and transitional age youth housing projects proposed in D2 – but as far as the housing project planned for the King Edward II Inn, which has generated some controversy among neighborhood groups, he didn’t take a strong position either way, saying he wanted to listen to all the stakeholders first.

Elected for a second two-year term as President of the Board, D3 Sup. David Chiu is rumored to be running in the mayor’s race, after he turned down former Mayor Gavin Newsom’s offer to appoint him as District Attorney. That offer was made after Kamala Harris won the state Attorney General’s race this fall. And when Chiu turned it down, former Mayor Gavin Newsom shocked just about everybody by appointing San Francisco Police Chief George Gascon, who is not opposed to the death penalty and was a longtime Republican before he recently registered as a Democrat, instead.

A temporary member of the Board’s Budget acommittee, Chiu is also a permanent member of the Board’s Government Audits & Oversight Committee.

Asked about his top priorities, Chiu spoke first and foremost about  “ensuring that we have a budget that works for all San Franciscans, particularly the most vulnerable.” He also said he wanted to see a different kind of budget process: “It is my hope that we do not engage in the typical, Kabuki-style budget process of years past under the last couple of mayors, where the mayor keeps under wraps for many months exactly what the thinking is on the budget, gives us something on June 1 for which we have only a couple of weeks to analyze, and then engage in the tired back-and-forth of debates in the past.” Chiu also spoke about tackling “looming pension and health care costs.”

Another priority, he said, was “Ensuring that our neighborhoods continue to remain the distinctive urban villages that they are, and protecting neighborhood character,” a goal that relates to “development, … historic preservation, [and] what we do around vacant commercial corridors.”

*Immigrant rights also made his top-five list. “I was very sad that last November we didn’t prevail in allowing all parents to have a right and a voice in school board elections,” he said, referencing ballot measure Proposition D which appeared on the November 2010 ballot. “I think we are going to reengage in discussion around Sanctuary City, another topic I have discussed twice already with Mayor Lee.”

Another issue for Chiu was  “ensuring again that hopefully San Francisco continues to remain an economically diverse city, and not just a city for the very wealthy.” He spoke about reforming city contracts: “In particular, dealing with the fact that in many areas, 70 to 80 percent of city contracts are awarded to non-San Francisco businesses. … I think there is more significant reform that needs to happen in our city contracting process.” Another economic-diversity measure, he said, was tax policy, “particularly around ensuring that our business tax is incenting the type of economic growth that we want.”

Finally, Chiu spoke about “Creating a transit-first city. This is not just about making sure MUNI is more reliable and has stable funding, but ensuring that we’re taking steps to reach a 2020 goal of 20 percent cycling in the city. Earlier this week I called for our transit agencies to look at pedestrian safety, because we are spending close to $300 million a year to deal with pedestrian deaths and injuries.”

District 4

Chiu has just named Sup. Carmen Chu as chair of the powerful Board and Finance Committee. And Chu, who worked as a budget analyst for Newsom’s administration, says the budget, core services, employment and the economy are her top priorities.

“My hope is that this year the budget is going to be a very collaborative and open process,” Chu said.

Chu believes workers benefits will be a central part of the budget-balancing debate.
“Any conversation about the long-term future of San Francisco’s budget has to look at the reality of where the bulk of our spending is,” she said.

Chu noted that the budget debate will have to take the state budget into account.
“At the end of the day, we need to take into account the context of the state budget, in terms of new cuts and taxes, because anything we do will be on top of the state level.

“We need to ask who do these measures really impact,” she added, noting that there were attempts to put revenue measures on the ballot last year.

District 5

With only two years left to serve on the Board, D5 Sup. Ross Mirkarimi has been named chair of the Board’s Public Safety Committee and vice-chair of the Budget and Finance Committee.

“One of my top priorities is building on and strengthening the work that I’ve already done and that Avalos is doing on mandatory local hire and First Source programs,” Mirkarimi said. He also spoke about “strengthening reentry programs for those coming out of the criminal justice system, because we still have an enormously high recidivism rate.”

The budget also ranked high on Mirkarimi’s list, and he stressed the need for “doing surgical operations on our budget to make sure that services for the vulnerable are retained, and looking for other ways to generate revenue beyond the debate of what’s going on the ballot.

“For instance, I helped lead the charge for the America’s Cup, and while the pay-off from that won’t be realized for years, the deal still needs to be massaged. What we have now is an embryonic deal that still needs to be watched.”

Mirkarimi mentioned safeguarding the city against privatization, saying one of his priorities was “retooling our budget priorities to stop the escalating practice of privatizing city services.”

 He spoke about “ongoing work citywide to make mixed-use commercial and residential infrastructure improvements, which coincide with bicycle and pedestrian improvements.”

Finally, Mirkarimi said he wanted to focus on transportation issues. “As Chair of the Transportation Authority, if I even continue to be chair, to take the lead on signature transit projects and work with the M.T.A. to reverse service cuts.”

Sup. Jane Kim
District 6

Elected to replace termed-out D6 Sup. Chris Daly, Kim has been named chair of the Rules Committee and a member of the Budget & Finance committee.

Kim believes that she will prove her progressive values through her work and she’s trying to take the current debate about her allegiances on the Board in her stride.

“The one thing I learned from serving on the School Board was to be really patient,” Kim told me, when our conversation turned to the issue of “progressive values.”

“I didn’t want to be President of the School Board for the first few years, because I loved pushing the envelope,” Kim added, noting that as Board President David Chiu is in the often-unenviable position of chief negotiator between the Board and the Mayor.

But with Ed Lee’s appointment as interim mayor, Kim is excited about the coming year.
“There are a lot of new opportunities, a different set of players, and it’s going to be very interesting to learn how to traverse this particular scene.”

Kim is kicking off her first term on the Board with two pieces of legislation. The first seeks to address bedbug infestations. “Particularly around enforcement, including private landlords,” Kim said, noting that there have also been bedbug problems in Housing Authority properties.

Her second immediate goal is to look at pedestrian safety, a big deal in D6, which is traversed by freeways with off-ramps leading into residential zones.
“Pedestrian safety is a unifying issue for my district, particularly for all the seniors,” Kim said, citing traffic calming, speed limit enforcement and increased pedestrian traffic, as possible approaches.

Beyond those immediate goals, Kim plans to focus on jobs, economic development and small businesses in the coming year. “What can we do to create jobs and help small businesses? That is my focus, not from a tax reduction point of view, but how can we consolidate the permitting and fees process, because small businesses are a source of local jobs.”

Kim plans to help the Mayor’s Office implement Sup. John Avalos’ local hire legislation, which interim Mayor Ed Lee supports, unlike his predecessor Mayor Gavin Newsom.

“Everyone has always liked the idea of local hire, but without any teeth, it can’t be enforced,” Kim observed. “It’s heartbreaking that young people graduate out of San Francisco Unified School District and there’s been not much more than retail jobs available.”

She noted that jobs, land use and the budget are the three overarching items on this year’s agenda. “I’m a big believer in revenue generation, but government has to come half-way by being able to articulate how it will benefit people and being able to show that it’s more than just altruistic. I think we have to figure out that balance in promoting new measures. That’s why it’s important to be strong on neighborhood and community issues, so that folks feel like government is listening and helping them. I don’t think it’s a huge ask to be responsive to that.”

Kim said she hoped the new mayor would put out a new revenue measure, enforce local hire, and implement Sup. David Campos’ legislation to ensure due process for immigrant youth.

“I think Ed can take a lot of the goodwill and unanimous support,” Kim said. “We’ve never had a mayor without an election, campaigns, and a track record. Usually mayors come in with a group of dissenters. But he is in a very unique position to do three things that are very challenging to do. I hope raising revenues is one of those three. As a big supporter of local hire, I think it helps having a mayor that is committed to implement it. And I’m hoping that Ed will implement due process for youth. For me, it’s a no brainer and Ed’s background as a former attorney  for Asian Law Caucus is a good match. Many members of my family came to the U.S. as undocumented youth, so this is very personal. Kids get picked up for no reason and misidentified. People confuse Campos and Avalos, so imagine what happens to immigrant youth.”

Sup. Sean Elsbernd
District 7

With two years left to serve on the Board, D7 Sup. Sean Elsbernd has been named vice-chair of the Rules Committee and a member of the City Operations & Neighborhood Services Committee. He was congratulated by Chinatown powerbroker Rose Pak immediately after the Board voted 11-0 to nominated former City Administrator Ed Lee as interim mayor, and during Lee’s swearing-in, former Mayor Willie Brown praised Elsbernd for nominating Lee for the job.

And at the Board’s Jan. 11 meeting before the supervisors voted for Lee, Elsbernd signaled that city workers’ retirement and health benefits will be at the center of the fight to balance the budget in the coming year.

Elsbernd noted that in past years, he was accused of exaggerating the negative impacts that city employees’ benefits have on the city’s budget. “But rather than being inflated, they were deflated,” Elsbernd said, noting that benefits will soon consume 18.14 percent of payroll and will account for 26 percent in three years. “Does the budget deficit include this amount?” he asked.

And at the afterparty that followed Lee’s swearing in, Public Defender Jeff Adachi, who caused a furor last fall when he launched Measure B, which sought to reform workers’ benefits packages, told the Guardian he is not one to give up lightly. “We learned a lot from that,” Adachi said. “This is still the huge elephant in City Hall. The city’s pension liability just went up another 1 percent, which is another $30 million.”

As for priorities, Elsbernd broke it down into district, city, and regional issues. In D7, “Hands-down, without question the biggest issue … is Parkmerced,” he said, starting with understanding and managing the environmental approval process. If it gets approved, he said his top concerns was that “the tenant issue. And the overriding concern of if they sell, which I think we all think is going to happen in the near-term – do those guarantees go along with the land?”

Also related to Parkmerced was planning for the traffic conditions that the development could potentially create, which Elsbernd dubbed a “huge 19th Avenue issue.”

Citywide, Elsbernd’s top priorities included enforcing Proposition G – the voter-approved measure that requires MUNI drivers to engage in collective bargaining – and tackling pension and healthcare costs. He spoke about “making sure that MTA budget that comes to us this summer is responsive” to Prop G.

As for pension and healthcare, Elsbernd said, “I’ve already spent a good deal of time with labor talking about it, and will continue to do that.” But he declined to give further details. Asked if a revenue-generating measure could be part of the solution to that problem, Elsbernd said, “I’m not saying no to anything right now.”

On a regional level, Elsbernd’s priority was to help CalTrain deal with its crippling financial problem. He’s served on that board for the last four years. “The financial situation at CalTrain – it is without question the forgotten stepchild of Bay Area transit, and the budget is going to be hugely challenging,” he said. “I think they’ll survive, but I think they’re going to see massive reductions in services.”

Sup. Scott Wiener
District 8

Elected in November 2010 to replace termed-out D8 Sup. Bevan, Wiener has been named a temporary member of the Board’s Budget and Finance Committee and a permanent member of the Land Use and Economic Development Committee.

“Transportation is a top priority,” Wiener said. ‘That includes working with the M.T.A. to get more cabs on the street, and making sure that the M.T.A. collectively bargains effectively with its new powers, under Prop. G.”

“I’m also going to be focusing on public safety, including work around graffiti enforcement, though I’m not prepared to go public yet about what I’ll be thinking,” he said.

“Regulating nightlife and entertainment is another top priority,” Wiener continued. “I want to make sure that what we do is very thoughtful in terms of understanding the economic impacts, in terms of jobs and tax  revenues, that this segment has. With some of the unfortunate incidents that have happened, it’s really important before we jump to conclusions that we figure out what happened and why. Was it something the club did inappropriately, or was it just a fluke? That way, we can avoid making drastic changes across the board. I think we have been very reactive to some nightclub issues. I want us to be more thoughtful in taking all the factors into consideration.”

“Even if we put a revenue measure on the June or November ballot, we’d need a two-thirds majority, so realistically, it’s hard to envision successfully securing significant revenue measure before November 2012,” Wiener added. “And once you adopt a revenue measure, it takes time to implement it and revenue to come in, so it’s hard to see where we’ll get revenue that will impact the 2012 fiscal year. In the short term, for fiscal year 2011/2012, the horse is out of the barn”

“As for pension stuff, I’m going to be very engaged in that process and hopefully we will move to further rein in pension and retirement healthcare costs.”

Sup. David Campos
District 9

Elected in 2008, D9 Sup. David Campos has been named chair of the Board’s Government Audit & Oversight Committee and a member of the Public Safety Committee. And, ever since he declared that the progressive majority on the Board no longer exists, in the wake of the Board’s 11-0 vote for Mayor Ed Lee, Campos has found his words being used by the mainstream media as alleged evidence that the entire progressive movement is dead in San Francisco.

“They are trying to twist my words and make me into the bogey man,” Campos said, noting that his words were not a statement of defeat but a wake-up call.

“The progressive movement is very much alive,” Campos said. “The key here is that if you speak your truth, they’ll go after you, even if you do it in a respectful way. I didn’t lose my temper or go after anybody, but they are trying to make me into the next Chris Daly.”

Campos said his overarching goal this year is to keep advancing a good government agenda.

“This means not just making sure that good public policy is being pursued, but also that we do so with as much openness and transparency as possible,” he said.

As a member of the Board’s Public Safety Committee, Campos says he will focus on making sure that we have “as much community policing as possible.

He plans to focus on improving public transportation, noting that a lot of folks in his district use public transit.

And he’d like to see interim mayor Ed Lee implement the due process legislation that Campos sponsored and the former Board passed with a veto-proof majority in 2009, but Mayor Gavin Newsom refused to implement. Campos’ legislation sought to ensure that immigrant youth get their day in court before being referred to the federal immigration authorities for possible deportation, and Newsom’s refusal to implement it, left hundreds of youth at risk of being deported, without first having the opportunity to establish their innocence in a juvenile court.
‘We met with Mayor Lee today,” Campos told the Guardian Jan. 18. “And we asked him to move this forward as quickly as possible. He committed to do that and said he wants to get more informed, but I’m confident he will move this forward.”

Campos also said he’ll be focusing on issues around workers’ rights and health care.
“I want to make sure we keep making progress on those fronts,” Campos said.

“It’s been a rough couple of days,” Campos continued, circling back to the beating the press gave him for his “progressive” remarks.“But I got to keep moving, doing my work, calling it as a I see it, doing what’s right, and doing it in a respectful way. The truth is that if you talk about the progressive movement and what we have achieved, which includes universal healthcare and local hire in the last few years, you are likely to become a target.”

District 10

Elected to replace termed-out D10 Sup. Sophie Maxwell, Cohen has been named chair of the City & School District committee, vice chair of the Land Use and Economic Development Committee and vice chair of the Public Safety Committee.

Cohen says her top priorities are public safety, jobs, open space, which she campaigned on, as well as creating community benefits districts and putting an end to illegal dumping.

“I feel good about the votes I cast for Ed Lee as interim mayor and David Chiu as Board President. We need to partner on the implementation of local hire, and those alliances can help folks in my district, including Visitation Valley.”

“I was touched by Sup. David Campos words about the progressive majority on the Board,” she added. “I thought they were thoughtful.”

Much like Kim, Cohen believes her legislative actions will show where her values lie.
“I’d like to see a community benefits district on San Bruno and Third Street because those are two separate corridors that could use help,” Cohen said. 

She pointed to legislation that former D10 Sup. Sophie Maxwell introduced in November 2010, authorizing the Department of Public Works to expend a $350,000 grant from the Solid Waste Disposal Clean-Up Site trust fund to clean up 25 chronic illegal dumping sites.
“All the sites are on public property and are located in the southeast part of the city, in my district,” Cohen said, noting that the city receives over 16,000 reports of illegal dumping a year and spends over $2 million in cleaning them up.

District 11

Sup. John Avalos, who chaired the Budget committee last year and has just been named Chair of the Board’s City Operations and Neighborhood Services Committee, said his top priorities were implementing local hire, improving Muni and Balboa Park BART station, building affordable housing at Balboa, and improving city and neighborhood services.

“And despite not being budget chair, I’ll make sure we have the best budget we can,” Avalos added, noting that he plans to talk to labor and community based organizations about ways to increase city revenues. “But it’s hard, given that we need a two-thirds majority to pass stuff on the ballot,” he said.

Last year, Avalos helped put two measures on the ballot to increase revenues. Prop. J sought to close loopholes in the city’s current hotel tax, and asked visitors to pay a slightly higher hotel tax (about $3 a night) for three years. Prop. N, the real property transfer tax, h slightly increased the tax charged by the city on the sale of property worth more than $5 million.

Prop. J secured only 45.5 percent of the vote, thereby failing to win the necessary two-thirds majority. But it fared better than Prop. K, the competing hotel tax that Newsom put on the ballot at the behest of large hotel corporations and that only won 38.5 percent of the vote. Prop. K also sought to close loopholes in the hotel tax, but didn’t include a tax increase, meaning it would have contributed millions less than Prop. J.

But Prop. N did pass. “And that should raise $45 million,” Avalos said. “So, I’ve always had my sights set on raising revenue, but making cuts is inevitable.”

Life and death in Sunnydale

On the first Friday afternoon in September, as most folks were trying to get an early start on their Labor Day weekend, C.L.A.E.R. director Sharen Hewitt and her advisory board member Carrie Manuel welcomed friends, family, neighbors—and a handful of D10 candidates—to a basketball hoop dedication ceremony outside C.L.A.E.R.’s office on Brookdale Ave at the heart of the  violence-racked Sunnydale housing project in Visitacion Valley.

By afternoon”s end, Hewitt had managed to get D 10 candidates Malia Cohen, Kristine Enea, Chris Jackson, Tony Kelly and Marlene Tran shooting hoops with a dozen African American youngsters who live in Sunnydale, the city’s largest public housing project, and talking about what they have learned about life and death in this deceptively pleasant-looking sun-and-fog bathed spot that overlooks the Bay, backs onto McLaren Park and the neighboring Gleneagles Golf course–little knowing that within two hours, yet another young black man would be fatally shot one block away from C.L.A.E.R.’s office.

Sunnydale’s appealing geographical location has made it the target of redevelopment plans that seek to rebuild 785 low income unit and add 925 market rate units into the mix—plans that have Hewitt concerned that Sunnydale’s current residents could end up being displaced through a combination of factors, including the San Francisco Housing Authority’s  announcement that many of these residents owe thousands in back rent, and City Attorney Dennis Herrera’s announcement that he is seeking a gang injunction against 41 alleged members of the Down Below Gangsters and the Towerside Gang, who have been engaged in a violent turf war in the Suinnydale for the past three years.

Many of these alleged gang members don’t actually live in Sunnydale, but their friends, families and their own children still do. Currently, seventy-five percent of lease holders in Sunnydale are single female heads of household. And while African Americansaccount for only six percent of San Francisco’s population citywide, black males represent 60 percent of the county jail’s population and feature in disproportionately high numbers in the city’s homicide statistics.

An unfortunate case in point occurred just hours after C.L.A.E.R.’s basketball hoop dedication, when 38 year old Asa Roberts was fatally shot on the first block of Brookdale Avenue, which is a stone’s throw from Hewitt’s office. Found after police responded to a report of gunshots at 8:20 p.m. at the Sunnydale projects, Roberts was pronounced dead at San Francisco General Hospital on what was his 38th birthday, making him the city’s 35th homicide this year.

And at the C.L.A.E.R. ceremony, held at 5:30 p.m. that day, the majority of kids in attendance raised their hands when asked if they knew someone who had been murdered—a shocking illustration of the traumatic stress that these children live with, even as they reside in one of the richest cities in the world

“This is more than just a basketball dedication ceremony and this is hardly just any basketball hoop, this hoop represents a small step toward safety and security for the residents of Sunnydale public housing,” Hewitt told the crowd, just hours before she would find herself rushing around the projects, trying to determine if families and kids in Sunnydale were safe, in the wake of Roberts’ shooting.

“In remembrance of Labor Day, one mother’s labor of love will unite a community under siege,” Hewitt said at C.L.A.E.R.’s 5:30 p.m. hoop dedication, recalling how she had seen Carrie Manuel’s four boys playing basketball against the wall of a public housing unit that was home to an old gas line with pipes that were in dire need of repair. Shocked, Hewitt called upon city partners and C.L.A.E.R. donors in an effort to get these boys a real hoop and thus minimize safety concerns.

“Because the little things change a community, “ Hewitt said.

Hewitt recalled how Sup. Bevan Dufty put her in touch with the Department of Recreation and Parks and the San Francisco Parks Trust, when he heard about the basketball hoop situation, and that these departments helped heed her call to action.

Hewitt also tipped her hat to the five D 10 candidates who attended the hoop dedication: Kristine Enea for being the first to respond to this particular crisis, Malia Cohen for her ongoing support of CLAER’s Brookdale Center, Tony Kelly for his general support of the community, Chris Jackson for connecting Sunnydale residents, including four named in Herrera’s gang injunction, to the Gateway to College program, and Marlene Tran for her work on public safety.

After the dedication, Hewitt paired each D10 candidate with one of the bright-eyed small boys that were eagerly waiting to play ball, as Manuel looked on.

“She’s a woman under siege,” Hewitt said of Manuel, recalling how this woman and her kids witnessed a homicide outside their window, and how Manuel’s 16-year-old son was murdered before his child—her first grandson—was born. “This family has been besieged by no less than three murders, but they don’t even have space to run up and down,” Hewitt observed.

“Look at what we do with nothing,” Hewitt said, pointing to the basketball hoop outside C.L.A.E.R.’s office. “We are not a service provider in a box.”

“Look at this beautiful property,” Hewitt said, pointing to the Bay that sparkled in the distance below and the fingers of  fog that tumbled across the sun-baked hills behind Viz Valley. “But this has not been such a beautiful place. This has been a forgotten district, a forgotten neighborhood, but not in our name.”

“This mother,” Hewitt continued, pointing to Manuel, “must be embraced by all of you. And we must give these boys more options than a cage or a coffin.”

Hewitt was referring to the disproportionately high number of young black males that end up jailed or dead in San Francisco, with many of those arrests and fatalities occurring in and around Sunnydale. But while the City Attorney’s office has responded to this pattern of crime and violence by issuing gang injunctions, Hewitt believes this strategy is a waste of money and resources, given that local non-profits which seek to provide education and restorative justice, have just had their budgets decimated.

Last month, City Attorney Dennis Herrera filed an injunction naming 41 alleged members of the Down Below Gangsters and the Towerside Gang, claiming that the two groups were engaged in turf wars that had terrorized the residents of the Sunnydale housing projects for the last three years. And on Thursday, September 30, Herrera will go to court to try to get a judge to support his injunction request.

But Hewitt fears that Herrera’s injunction will further stress an already fragile community.

“Gang injunctions are plaguing this neighborhood and their families, but we don’t have gangs, we have families,” Hewitt said, as local residents Larry C. Jones of TURF and the Marsha Kyer Foundation, and Robert Cowan, watched the kids and candidates play ball.

After the basket ball game, Hewitt asked the five D10 candidates what they had learned from the C.L.A.E.R-sponsored event

“I’m struck by how strong the entrepreneurial spirit is,” Marlene Tran said, surveying a greeting card business that Sunnydale youth Tyree Vaughan started, under the auspices of C.L.A.E.R. “For 35 years, I was with kids every day,” Tran continued, referring to her career as a teacher. “And when I was 9 years old in Hong Kong, I helped my mother with work, and at 16, I had my own import/export business. So, we should recognize youth, all the positive things they do.”

 

Kristine Enea also praised the entrepreneurial spirit that was evident on the ground in Sunnydale.”Entrepreneurship is a powerful drug,” Enea observed. “Every child should know the joy of holding in your hands a product that started as an idea in your head,”

 

“This neighborhood is getting ready to be demolished,” Hewitt interjected. “What do we have to do with Project Hope?”

Tony Kelly admitted that he had never been to C.L.A.E.R.’s office before.
“But I’ve been involved with Hope SF on Potrero Hill,” Kelly said. “With Hope SF, there’s this weird thing of competition between public housing sites, this, ‘Oh, we can only get one project taken care of,’ and ‘Oh, we can’t get services’  attitude. But this is the largest public housing project in the city. We need complete neighborhoods where we live.”

Chris Jackson complimented C.L.A.E.R. on doing so much with so little.
“When I look at how many millions we spend on community services, but not something as simple as a basketball hoop, which gives a dozen black youth access to exercise, team work and figuring out how to work together, I see that you are doing with $300 what Goodwill and JHS failed to do with millions,” Jackson said.” You have brought the community together.”

Hewitt, who likes to call herself Mini Mouse and isn’t afraid to challenge her biggest supporters, responded by urging the candidates to get more hands on.

“The rhetoric doesn’t bode well for the community,” Hewitt said. “You can’t only come here every six months.”

Malia Cohen, who is on C.L.A.E.R.’s board, expressed her belief that the community needs to do more in terms of giving back.
“This is a partnership, I brought resources here, but people who live here ought to respect the resources, and say, this is our home and we are going to sweep up,” Cohen said, pointing to untended pathways and a couple of wilted potted plants that had died for lack of watering outside C.L.A.E.R.’s office.

“You did this because you are a board member,” Hewitt retorted, giving Cohen, who she supports politically, a predictably hard time.“But where are we collectively in terms of challenging ourselves to respond?”

 “I see great opportunities here, but because of budget cuts, you haven’t had resources,” Cohen continued. “The Department of Children, Youth and Families has been funneling funds to mega-organizations, and not the grassroots.”

“One opportunity is with City College,” Jackson, who counts Hewitt as a mentor, interjected. “And we can give deeper. I believe 20 percent of our participants are from Viz Valley, and we can do a better job of reaching out to the 41 young men listed on gang injunction. It’s something the City Attorney should have talked about before he put in for the gang injunction. A week later, he declares he’s running for mayor, while those of us on the ground are left to clean up.”

“785 units will come back as low-income and there is a zero vacancy rate here, so the one-to-one replacement of the units is not so much the issue as the replacement of the people,” Hewitt told me, as she locked up her office and the rest of the city prepared to enjoy a Labor Day weekend in a world that is not scarred by memories of fblack and brown brothers dying in a hail of bullets in the street.

And as I drove away, towards the bonfire of vanities that is downtown San Francisco, I couldn’t shake the twin images of those young black boys raising their hands when asked if they knew someone who has been murdered, and of Hewitt, fearlessly grilling the D10 candidates, even as she tries to hold together this fragile community of color on a prayer and an increasingly frayed shoelace budget.

The news that didn’t make the news in SF

Every year, the Guardian features the Top 10 Project Censored stories presented by the Sonoma State University project that spends all year analyzing which stories the mainstream media missed. But which stories did not find their way into the mainstream press here in the San Francisco Bay Area?

News outlets other than the Guardian typically ignore Project Censored (unless you count SF Weekly’s snark), so you might say that even Censored tends to be censored. Other than that, we note that issues not hand-delivered via press release or PR campaign might receive less attention than those obvious stories. Using a rather unscientific process of surfing alternative news sites online to find out which stories didn’t get a lot of play in the mainstream, we’ve come up with an assortment of Local Censored stories – though this is by no means a comprehensive list. What other news didn’t make the news?

* What we didn’t hear about when PG&E was pushing Prop 16

Speaking at an informational hearing in Sacramento in February 2010 about Pacific Gas & Electric Co.’s ballot initiative, Proposition 16, former California Energy Commissioner John Geesman noted that the state’s most powerful utility company was using customer money to finance a bid to change the state constitution for its own purposes. Prop 16, which earned a thumbs-down from voters in the June election, would have created a two-thirds majority vote requirement before municipalities could set up electricity services separate from PG&E. While there was no shortage of reporting about the astounding sums of cash that PG&E sank into Prop. 16, hardly anyone aside from Geesman picked up on the more salient point of what PG&E was not spending its money on.

“California’s investor-owned utilities face a Himalayan task in modernizing our electricity system and building the infrastructure necessary to serve a growing economy,” Geesman wrote on his blog, titled PG&E Ballot Initiative Fact Sheet. “They ought to focus on that, rather than manipulating the electorate to kneecap their few competitors.” It is now abundantly clear that PG&E’s aging gas pipelines in San Bruno were badly in need of replacement – and the utility’s neglect opened the door the catastrophic explosion that occurred Sept. 9, resulting in tragic loss of life and destroying homes. “The current leadership at PG&E has lost its way. Nobody is minding the ship,” senator Mark Leno told the Guardian shortly after the blast. “Enough with the self-initiated, self-serving political campaigns. … How about focusing on the current mission — to provide gas and electricity safely, without death and destruction?”

* What you might not have read about Johannes Mehserle’s murder trial
 
If you looked to Colorlines.com, Blockreportradio.com, the San Francisco Bay View, or Indybay.org for coverage of Johannes Meherle’s murder trial for the fatal shooting of Oscar Grant, then you got a different picture from the one offered by mainstream Bay Area news outlets. There may well be plenty of details about the trial that didn’t make the cut for mainstream news, but one particular point caught our eye as something that should’ve warranted more prominent coverage, or at very least sparked deeper questions from mainstream press. According to the witness testimony of Jackie Bryson, who was with Grant on the train platform the night of the shooting, Grant’s friends immediately urged BART police to call an ambulance after Grant had been shot, but police didn’t do it right away.

Here’s the report from Block Report Radio: “Jack Bryson said he yelled at Oscar after he was shot to stay awake and to the police to call the ambulance. The unidentified officer who was on Bryson declared, ‘We’ll call the ambulance when you shut the fuck up!’ Bryson went on to say that he was never searched on the Fruitvale platform or at the Lake Merritt BART police station, which seems ridiculous if you consider the earlier testimony of former BART police officers Dominici and Pirone, who were involved in the murder and who testified last week that they had felt threatened by Oscar Grant and his friends.” So, if it’s true that Grant’s friends were told to “shut the fuck up” when they were urging BART cops to call an ambulance, and that the supposedly threatening parties weren’t ever searched, why didn’t these points receive as much attention in the media as, say, the claim that years earlier, Grant may have resisted arrest? After witnessing the death of his friend, Bryson said in his testimony, he was detained for hours while wearing handcuffs pulled so tight that his wrists hurt, only to be told afterward that since he had not been read his Miranda rights, he was not under arrest. To be fair, the detail about calling the ambulance did make it into the Chronicle, near the bottom of a blog post, under the subhead, “Friend’s claim.”

* Homelessness on the rise in San Francisco

The controversy surrounding Prop L, a proposed ordinance to ban sitting and lying down on the sidewalk, has been widely reported on — but there’s a more pressing issue related to homelessness that hasn’t gotten nearly as much ink. An article in New America Media, “Shelters predict homeless count to skyrocket,” highlighted a perceived surge in San Francisco’s homeless population, evidenced by overwhelmed service providers who can hardly keep up with demand. “We’re serving 200,000 more meals per year than two years ago, but we haven’t had the capacity to add staff,” the chief executive officer of the Glide Foundation noted in the article. The drop-in center, she added, no longer had enough seats to accommodate those in need. According to a fact sheet issued by the Coalition on Homelessness in July of 2009, 45 percent of respondents to a COH survey were experiencing homelessness for the first time. The overwhelming majority of respondents, 78 percent, became homeless while living in San Francisco.

* The long wait for Section 8

It isn’t easy for a tenant with a Section 8 voucher to find housing in the San Francisco Bay Area. In San Francisco, there’s a barrier to getting the voucher in the first place, since the waitlist is currently closed. Those who have vouchers are often passed over by landlords, and the string of denials can drive people to unstable housing situations such as extended hotel stays. An article in POOR Magazine features the story of Linda William, a woman who left a San Francisco public housing project with a Section 8 voucher in hand only to embark on a wild goose chase, ultimately winding up in a low-end motel outside Vallejo. “Well whaddya know,” William told the POOR magazine reporter, “I found closed wait lists on almost all the low-income housing units in all of those places and all the rest of the landlords wouldn’t even return my calls when I told them I had section 8.” An article by Dean Preston of Tenants Together that appeared in BeyondChron, meanwhile, spotlights the issue of landlord discrimination against Section 8 tenants.  “In the Section 8 voucher program, participating tenants pay 30 percent of their rent and the Housing Authority pays the balance to the landlord,” Preston writes. “It takes years for eligible tenants to be able to participate in the program. Once tenants get off the wait list, the landlord must sign a payment contract with the housing authority in order to receive the portion of the rent paid by the government. By refusing to sign onto the program, some landlords seek to force rent controlled tenants into situations where they cannot pay their rent.”

* San Francisco’s trashy secret

Despite being thought of as a beacon of sustainability, San Francisco’s not-so-green waste stream is something that didn’t make the front page of many papers – except, of course, this one. Sarah Phelan’s “Tale of Two Landfills,” a Guardian cover story this past June, examined San Francisco’s decidedly unenlightened policy of transporting waste far outside of the city despite a goal of reducing waste to zero in the next 10 years. Here’s an excerpt: “It’s a reminder of a fact most San Franciscans don’t think much about: The city exports mountains of garbage into somebody else’s backyard. While residents have gone a long way to reduce the waste stream as city officials pursue an ambitious strategy of zero waste by 2020, we’re still trucking 1,800 tons of garbage out of San Francisco every day. And now we’re preparing to triple the distance that trash travels. ‘The mayor of San Francisco is encouraging us to be a green city by growing veggies, raising wonderful urban gardens, composting green waste and food and restaurant scraps,’ Irene Creps, a San Franciscan who owns a ranch in Wheatland, told us. ‘So why is he trying to dump San Francisco’s trash in a beautiful rural area?’”

* The real unemployment rate

The Bureau of Labor Statistics makes a distinction between so-called “discouraged workers” who have stopped looking for jobs, and the jobless who are actively seeking employment, so the official unemployment rate (9.7 percent in San Francisco, according to the most recent data) may be much lower than the actual unemployment rate.

We haven’t seen any brilliant local reporting on this issue, but the problem is summed up nicely in this YouTube video produced by a personal finance software firm.

Nearly four years after City Attorney Dennis Herrera filed suit against Frank and Walter Lembi and their dizzying array of companies affiliated with CitiApartments for “an outrageous pattern of corporate lawlessness,” the powerful and notorious San Francisco landlords have watched their empire crumble.

The Lembi empire consisted of more 300 apartment buildings in San Francisco at its peak. Four Lembi subsidiaries that owned 16 buildings filed for Chapter 11 bankruptcy in February. Twenty Lembi properties were taken over by Lennar spin-off LNR in late May; another 24 buildings are slated to be foreclosed in early June; 51 were deeded back to UBS bank in lieu of foreclosure early last year; and still others are now held by court-appointed receivers and managed by Laramar, an unaffiliated property-management company.

CitiApartments still owns and manages a large portion of the buildings it controlled in its heyday, but it’s had to either restructure loans or get payment extensions to hold onto many of them, according to general counsel Ed Singer. The Lembi Group staff has dwindled, and a team of 18 dedicated solely to relocating tenants is now long gone.

For many renters in foreclosed units who managed to ride out what San Francisco Tenants Union director Ted Guillicksen has labeled CitiApartments’ “war of terror” against its occupants, the dust has finally settled. Gullicksen says that living in limbo is better than living under Lembi.

There are no more harassing phone calls pressuring them to move. No more sudden utility shutoffs. No armed agents showing up at the doorstep unannounced. No illegal construction projects clamoring away on the other side of paper-thin walls, destroying any hope of tranquility at home.

These are tactics CitiApartments used to drive people out, according Herrera’s 2006 complaint and an award-winning Guardian series (“The Scumlords,” March 25), in order to vacate units so they could be renovated and removed from rent control protections. A San Francisco Rent Board roster of 174 current and former Lembi properties as of May 25 lists no fewer than 1,890 cases associated with those buildings, the majority of them now settled.

While the sordid history of CitiApartments’ strong-arm tactics has been well-documented, tenant-rights advocates say the untold story of the Lembis’ rise and demise is that its entire business model hinged on evicting and relocating existing tenants — but that strategy failed, in large part because of a grassroots organizing effort that emboldened renters to stand their ground.

“The economic downturn played a role in it because the money stopped flowing,” says Gullicksen, who helped form the CitiStop Campaign in 2004 in response to reports of outrageous tactics. “But if the money kept flowing, I think they would have failed anyway. The end result was inevitable, given the tenant resistance.”

Darin Dawson moved into his apartment at 2 Guerrero St. in 1994 on a lease secured through the federal Housing Opportunities for People With AIDS program. Dawson, who was diagnosed in 1987, said things turned sour in 1998 when Trophy Properties I DE LLC — one of the Lembis’ dozens of subsidiaries — snapped it up.

Their first contact was to inform him that he would have to move “because we don’t allow those kinds of leases in our buildings,” he recalled. He fought it with the help of the Housing Authority and managed to stay put. It was the first in a series of standoffs that ultimately stopped last September when the property was repossessed.

“Basically, I just dug my heels in and knew that I couldn’t get evicted,” Dawson said. Nonetheless, he spent years embroiled in conflict with the Lembi subsidiary while also battling AIDS-related illnesses.

There was the time he was ordered to vacate his apartment for two weeks during a seismic retrofit only to find it trashed when he returned. “The floors were ripped up,” he said. “The ceiling was hanging in some places. There was black grease smeared all over the walls.” He repaired it himself. Then came the constant phone calls, which started off artificially cheerful but turned threatening if he refused to accept money to relocate.

Dawson pays a base amount of $635 per month for his rent-controlled studio, so he suspected he might be a target. Once a residential manager discreetly warned him that his name was on a “hit list” of tenants whom the owners wanted gone, he said.

According to a confidential document leaked to advocates by an anonymous source, tenants who paid the least came under the greatest pressure to relocate since San Francisco rent-control laws prohibit raising existing occupants’ rents to market rate. The document outlines how loan repayment and estimated profits were calculated wholly on the expectation that existing tenants would vacate, rather than relying on normal projections like natural turnover.

“Tenants with significantly below market rents are chosen for thorough screening to see if they might be relocated,” according to the document, a 2008 Credit Suisse prospectus concerning a pool of 24 buildings under Lembi ownership that have since been foreclosed. “Those tenants most below market and/or with the longest history are the priority for relocation.”

All 24 buildings in question — including properties on Larkin, Market, Cesar Chavez, Post, and Leavenworth streets, in addition to others — were subject to rent control. “At acquisition [Aug. 30, 2007], the portfolio was approximately 5 percent vacant,” it notes. “As of May 2008 the portfolio was 19 percent vacant, as a result of Lembi successfully executing their business plan of vacating units and rolling them to market.”

Although the paperwork spelling this out in stark terms didn’t surface until recently, advocates who worked on the CitiStop campaign essentially figured it out years ago. A collaboration between the Tenants Union, Pride at Work, and other advocacy groups, the campaign sent organizers door-to-door to inform tenants of their rights, hosted potlucks where people could swap horror stories and forge alliances, and staged demonstrations outside CitiApartments’ Market Street offices.

They tracked public records from the Assessor-Recorder Office and swooped in to warn tenants whose buildings had fallen into the Lembis’ clutches. It didn’t always work. According to the Credit Suisse document, Lembi had relocated 2,500 units as of August 2008, a fact pointed to as evidence of its “successful track record.” But the relocation team only drove out a small number of the lowest-paying tenants; the vast majority of those who took buyout offers left units that paid closer to market rate.

“They really needed to get more turnover than what they accomplished,” Gullicksen said. “The fact that they couldn’t is attributable to the CitiStop campaign.”

Singer rejected this assessment, saying the real problem was the economic downturn and the loss of capital availability. “I can see why they want to say that, why they want to take credit for bringing down the Lembis,” he said. “But I don’t think it would have made any difference if [tenants] left or not.”

A common complaint nowadays is that former tenants haven’t gotten their security deposits back, a matter that has spurred a class-action lawsuit against 57 corporate defendants associated with the Lembi Group.

“They’re claiming that they have no money,” Brian Devine, an attorney with Seeger Salvas LLP, told the Guardian. Devine estimates that he will end up representing several thousand tenants who are entitled to their deposits. In March, a judge awarded sanctions of $30,000 to Devine’s firm because the Lembi Group refused to cooperate with discovery, withholding documents necessary for the case to proceed.

Herrera has encountered a similar recalcitrance in his own suit and won court sanctions of $50,000 in February for the same reason. “We have been engaged in discovery for a long, long time,” noted city attorney spokesperson Matt Dorsey. “We’re hoping that the judge is at the edge of his patience.”

Singer said the problem was that there wasn’t enough “people power” to photocopy thousands of documents. The Lembis were never up to any nefarious purpose, Singer insisted — they only wanted to make the buildings nicer. As for the tenants who endured the most brutal relocation tactics? “I can understand why they didn’t want to leave,” he said. “Some of them didn’t leave — and they’re still there.”

U.S. Census begins, officials work to quell fears

Federal Census forms are being mailed out today, March 15. It’s a massive government effort to count everyone who lives in the United States that comes every 10 years, and it’s being matched by an equally strong effort by nonprofit groups to ensure that even marginalized residents get counted.

In a country that once counted slaves as 3/5 a person and did not count Native Americans at all, it appears that the 2010 census will come the closest to counting all people living in the U.S. Millions of dollars are being spent to inform people of the importance, and the function, of responding to the decennial census – and saving the feds from spending further millions on door-to-door enumerating. 

Among other things, the population count is used to determine the apportionment of public funds to various communities and of seats in the U.S. House of Representatives. Despite all the immigrant-bashing by right-wingers who claim to revere the U.S. Constitution, that guiding document requires that all persons, not just citizens, be counted. It is for this reason that special care is being taken to include the historically undercounted communities such as low-income families, non-English speakers, and immigrants both undocumented and documented.

For Alex Darr, office manager of the San Francisco census office that covers all of the Mission and Bayview districts, the task is difficult but familiar. A veteran of the 2000 census, when some estimates say as many as 100,000 San Francsicans were not counted, Darr says the census has evolved in both form and execution. 

What used to be a multi-page document with as many as 52 questions per person has now been whittled down to just 10. “Ten questions in ten minutes, we like to say around here,” says Darr. The questions are of the most basic sort, requesting the age, sex and race of every member of a household. It does not ask about citizenship. Even more reassuring to immigrants, 2010 is the first census that will be available en Español. Spanish language forms will be arriving in the Mission, but that and the laws that require participation may not be enough to encourage people to respond.

 The U.S. Census Bureau is actively recruiting bilingual speakers to work in the Mission and educate residents of the importance of the census for things like social services and infrastructure. Employing residents of the area, Darr says, will reassure people that responding to the census is not a risk when census-takers begin knocking on doors in late May because, “it’s easier to hear this from your neighbor.”

A document released by the census bureau estimates that for each percentage point of the population that does not return its census form by the April 14th deadline, the government will spend $80-90 million sending out census-takers to visit homes. Darr says that his office’s efforts will, “save [residents] some trouble, save the government some money as well.” San Francisco’s census-takers, with a starting salary of $22 per hour, will be among the highest paid in the country.

In addition to the boost in recruitment, Darr’s office has teamed up with a variety of community organizations to form the Mission Complete Count Committee and build on the existing relationships with residents. Rosario Anaya of the Mission Language and Vocational School (MLDS) says students at the center are being urged to pass on information about the census to their families and the building is being used as a training center for census workers. Anaya says the response has been good but there is hesitation. Some residents have told her, “We get counted but there’s no services coming back to us.”

Joel Aguiar of the SF Day Laborer program says his group trained day laborers and domestic workers to go out and engage their friends in discussion about the census. “When they think of the census, they’re not going to think of somebody knocking on their door,” Aguiar says of their program. Many of the workers are worried that by responding to the census, they would put their housing at risk by inadvertently revealing to the landlord or housing authorities how many live in their crowded homes.

But Aguiar says the laborers found that, “really a lot of their fears are unfounded.” Many of the community groups in the Mission will also be hosting Questionnaire Assistance Centers starting March 19th, with multilingual staffs to help anyone who needs help filling out forms. Information on individual QAC sites and much more on the census will be printed in El Tecolote’s late March issue.

MLDS is one of several groups who participated in conjunction with the city and the SF Recreation and Parks Department in a community soccer tournament over the weekend at Garfield Park. The tournament featured both adult and children’s teams representing the various social justice groups as well as a team fielded by the census bureau. Aguiar says the soccer games strengthened the census education effort by “associating it with something which is already a community event.”

The Mission is also home to a number of single room occupancy hotels, or SROs, that are another community that was vastly undercounted by the last census. “Many SROs don’t have buzzers, have absent managers, or have managers who will not let us in,” says Kendra Froshman of the Mission SRO Collaborative. In response, the Mission SRO has joined a citywide coalition formed by the Community Housing Partnership to push for legislation that would change SRO visitor policies to allow census workers to enter.

The Mission is not the only area on Darr’s agenda. While citizenship is not a major issue in Bayview-Hunter’s Point, investigation into the low mail-back rate after the 2000 census found that many residents did not return their forms simply because they did not have a mailbox on their street. It remains unclear if mailbox distribution is one of the many things the government uses census data to calculate, but for the 2010 census, the Postal Service and the Housing Authority have set up various locations in the neighborhood where people can drop off their completed forms to be mailed.

“We are starting at a new beginning point for people to understand the importance of being counted,” Bayview Census representative Omar Khalif says of the outreach effort he has been working on since last July. Khalif attributes the low return rate to misinformation, saying many of the people in the area are hesitant to divulge personal information to the government despite being on government assistance and living in government housing.

As part of the effort, many different groups, such as the SF Housing Development Corporation, have come together to form the Bayview Complete Count Committee and host a series of community events such as a Gospel feast on March 28, giving residents a chance to win prizes for turning in their forms early. Flyers posted in community centers urge residents that being counted could mean thousands of government dollars in funding for their neighborhood. Working with all the established groups has given the census office better access to an often-disenfranchised community, Khalif says: “This is something that benefits us as a whole.”

The first census since the 9/11 attacks and the federal government crackdown that followed has many has many people understandably worried about giving too much personal information to the government. Census data is used by a variety of government agencies as well as private entities for everything from allocating federal funds to academic research and even advertising.

Many undocumented people fear that participating in the Census will tip off ICE agents. However, personal census information, including names, is strictly confidential even to other agencies within the government. “If the president asked me for your census form, I can say ‘No, you can’t get it,'” U.S. Census Bureau Director, Robert Groves recently told a crowd of immigrants in a Texas bordertown.

The long form of the 2000 census asked a variety of questions including employment, living expenses, and citizenship. These questions are now found on the American Community Survey (ACS), which is sent out every year to a small percentage of homes and gives the Department of Commerce more up to date and in depth data on how Americans live. Yet fears on both sides of the issue persist.

Some Latino advocacy groups such as the National Coalition of Latino Clergy and Christian Leaders (CONLAMIC) have launched a campaign urging Latinos to boycott the census until Congress passes comprehensive immigration reform. “Before you count us you must legalize us,” proclaims the president and founder of CONLAMIC, Rev. Miguel Angel Rivera, on his website. Similarly, several conservative politicians have spoken out about counting non-citizens, as it will shift Congressional power and federal money to areas with high populations of immigrants.

Conservative U.S. Rep. Michelle Bachman (R-Minnesota) briefly called for a boycott of the census, saying on air that the survey is intrusive but does not ask the right questions. “This would be your perfect opportunity to find out how many illegal aliens are in [the] United States,” she suggested. She also cited the internment of Japanese-Americans in World War II as a misuse of Census data. Census Bureau officials have stated that the USA Patriot Act does not override the explicit, legally mandated confidentiality of the census. Government assurances do little to quell public fears, but it is possible that the boots on the ground work done by census takers and their partners in the various community groups around the city will make the 23rd census a success.

Who cares about San Francisco’s (black and brown) prisoners?

I knew Sup. Chris Daly was going to get slammed for his Feb. 23 vote against placing a $412 million earthquake-safety bond measure on the June ballot. I knew it when I heard him say the following: ”I care more about the people at the jail, the people who are there involuntarily, if we have a seismic incident, then I do about the rest of the people at 850 Bryant.”

Daly noted that he would have supported the bond package if it included money for new lockups, as was originally proposed.

‘What about the people in the jails?” Daly asked. “These are San Franciscans, my constituents, folks who are disproportionately people of color, folks who are disproportionately low-income and have been caught up in the criminal justice system.”

What I later discovered  was that several key figures in the local prison reform movement, including Dorsey Nunn of Legal Services for Prisoners with Children and Rhodessa Jones of the Medea Project, a visionary theater model for incarcerated women, were sitting in the Chambers, awaiting commendations as part of the city’s ongoing Black History Month celebrations.

Later that same afternoon, Sup Ross Mirkarimi honored Jones (left) and Idris Ackamoor (right) for their work with Cultural Oddysey. And afterwards, I caught up with Jones by phone to see what she thought of the plan not to rebuild the jails on Bryant Street , a decision apparently made to reduce the price of the city’s proposed seismic safety charter amendment by $250 million.

Jones, who conducted a residency at San Francisco county jail that resulted in the Medea Project, told me that these kind of inequitable decisions illustrate why she got motivated to do work inside jail, in the first place.

“When we walk into the jail, we try to educated the prisoners that they have no rights and no safety,” Jones said. “We are trying to find ways to infuse their lives with the political reality and end recidivism.”

She also noted that she has not been able to take the Medea Project inside the local jail because it’s gotten so crowded.

But last time she was there, the women were primarily black and brown and, according to Jones, “they are the fastest growing number inside.”

Jones, who is currently working on the issue of reparations and “how the prison-industrial complex looks so much like slavery,”  told me that in the 20 years since she began the Medea project, she’s learned that figuring out the questions around any issue is central to understanding it.

“So, are these folks not human beings as well? How do we transform the humanity? And what would Christ do? A lot of people don’t have any connection with an issue until it’s sitting at their dinner table,” Jones said.

The battle for the forgotten district

This November, when voters in District 10 — the largest, sunniest, and most diverse of the city’s 11 supervisorial districts — replace termed out Sup. Sophie Maxwell, they’ll be making a selection that could have pivotal implications for the entire city.

That’s because the next supervisor from southeast San Francisco inherits a district that is home to some of the city’s biggest environmental and public health challenges, as well as the most potential for development that will determine what kind of city San Francisco becomes.

District 10 is where you’ll find the most polluted and most underdeveloped lands in San Francisco, areas that could either be transformed into models of a sustainability or, in the words of Tony Kelly, the president of Potrero Boosters Neighborhood Association, “be turned into a toxic Foster City.”

District 10 is where the slaughterhouses, tanneries, and glue factories set up shop and used the bay as a dumping ground. It’s where the smokestacks of coal and oil fired power plants polluted the air. It’s where the Navy filled the Bay, built a shipyard at Hunters Point and loaded parts of the first atomic bomb onto the USS Indianapolis in 1945.

District 10 is where the bottom fell out of this industrial economy in 1974, when the Navy left, taking with it people’s jobs, pay, and hopes for a home of their own and a better future, particularly for what was then a predominantly African American population.

And District 10 is ground zero for plans that will triple the population and double the number of homes — homes that likely will only be “affordable” to Google executives and retirees from Marin, forever changing the face of San Francisco’s southeast sector. Critics fear that will accelerate what has been a steady exodus of black residents, replaced by megadeveloper Lennar’s vision for a new D10.

It’s against this dark history and difficult present that a wide open field of more than a dozen candidates are vying to replace Maxwell, who came to power in 2000 and has had a mixed voting record in her decade on the board. Sometimes, Maxwell was the eighth vote that let the progressive majority on the Board override Mayor Gavin Newsom’s veto and pass trailblazing legislation. Other times, she was the swing vote that allowed the moderate minority to carry Newsom’s water.

So, in addition to D10’s many internal challenges, this seat could determine the political balance of power on the Board of Supervisors, placing all the more importance on voters in this long-marginalized part of town.

 

DISTRICT OF DISCONTENT

Eric Smith, a biodiesel activist who has thrown his hat in the D10 ring, says that there is a lot of frustration in the air, and looking at the problems the district is facing, it’s hardly surprising that it has what nearly every candidate agrees is a fractured political culture.

“The Bayview, the Hunters Point Shipyard’s toxic Superfund site, the homicide rate, unemployment, poor public transportation, dwindling services and community resources have made D10 one of the city’s largest melting pots of discontent,” Smith said.

Smith’s words were spoken while the Elections Department was verifying signatures earlier this month on a second failed effort to qualify a petition to recall Maxwell.

Bayview resident and D10 candidate Marie Franklin didn’t support the attempt to recall Maxwell, but she understood it as “a frustration movement.”

“People are sinking in the sand, we’ve already lost so many of them, and they felt Sophie wasn’t doing anything for them,” said Franklin, who praised Maxwell for helping get Franklin’s apartment building complex renovated — a job that was completed 18 months ago, at a cost of $65 million, creating 500 local jobs.

“There are 654 units here, and they were uninhabitable,” Franklin said. “There was black mold, rain falling inside. We had people living worse than Haiti.”

Franklin, who said she is running because she “knows the history,” came here in 1978, when she and her son were living in a car after a fire left them homeless. She said the Bayview was a totally isolated area, barely part of mainstream San Francisco.

“There were no taxis, no services,” she recalled. “Nobody would come here, it was the stigmatized area where no one was accountable to provide services.”

The Bayview — which in some ways is the heart of D-!0 — wasn’t always a black community. But African Americans have been living here for 70 years, dealing with all the racism, denial of services, poverty, and pollution. And it bothers Franklin that 85 percent of the 10,500 homes that Lennar plans to develop won’t be affordable to the elderly, disabled, unemployed and low-income people who currently live in the Bayview.

“We need to preserve the diversity of the community and make sure their issues and information will flow to City Hall,” she said. “You must give the people a handle. If you don’t reach out, they’ll slip. That’s why folks out migrated.

Whoever succeeds Maxwell will be a central player in addressing some very big and dirty issues: the future of the Navy’s radiologically impacted shipyard at Hunters Point, Lennar’s massive redevelopment plan for the Shipyard and Candlestick Point, the polluting power plants, replacement of stinky digesters at the sewage plant, and the SF Hope public lousing rebuild.

There’s also the chance to address violence and crime. James Calloway, a candidate who has long worked in Bay Area schools, told us he believes that education and jobs are part of the keys to rejuvenating the district.

“Job opportunities are not as plentiful in the district,” Calloway said. “When I was a kid, you could walk down Third Street at 2 a.m. Now I wouldn’t walk down it at 9 p.m., and I know the area.”

Calloway is hopeful that the massive redevelopment plan, if done correctly, could start the district’s comeback. “Not a lot of black folks stay here when they have extensive education,” he said. “But it’s not only them. Many were displaced by redevelopment and had no way to go back.”

 

ELECTION UP FOR GRABS

The largest of the city’s 11 electoral districts, D10 is a huge triangular piece of land in the city’s southeast sector that was used as an industrial dumping zone for decades. Today, the district runs from the Giants stadium at AT&T Park to the 49ers stadium at Candlestick Point and encompasses Mission Bay, Potrero Hill, Dogpatch, India Basin, Portola, Little Hollywood, and Visitacion Valley. It’s also crossed by two freeways that isolate it from the rest of the city, and is home to a large number of crumbling housing projects that are in the process of being rebuilt.

Candidate Ed Donaldson grew up in the projects until he was 10 years old, when the Redevelopment Agency kicked his family out in the 1970s. “We landed on our feet, but others weren’t so lucky,” said Donaldson, who works as a housing counseling director at the San Francisco Housing Development Corporation.

“There is a sense that the Bayview and Visitacion Valley have not been included within the San Francisco family,” Donaldson said. “There is a sense of being forgotten.”

In 2007, Donaldson co-founded the Osiris Coalition to tackle the city’s dormant Certificate of Preference program, in which the Redevelopment Agency issued a document to displaced residents and businesses in the 1960s promising that they could return.

He also tried to rescue some 700 foreclosed properties and recycle them as affordable housing stock. And now he is trying to prevent the city from bulldozing seven SF Hope projects without guaranteeing residents that they have right to remain.

In 2007, Mayor Gavin Newsom and Maxwell convened an African American Outmigration Task Force that didn’t get a public hearing about its findings until August 2008. The timing angered some, who questioned why the report’s findings and implications for urban planning weren’t released before June 2008, when the residents of San Francisco voted for the Lennar-led Proposition G, a proposal to build 10,000 market rate homes at one of San Francisco’s last remaining black communities, which Newsom and Maxwell endorsed.

The taskforce didn’t publish its recommendations until the end of 2009, allegedly because of insider squabbling. Meanwhile, gentrification was going on actively, and many blamed Newsom, and by extension Maxwell, for failing to do anything with the group’s findings as D10 residents continued to suffer from high rates of asthma, cancer, unemployment and an ongoing black exodus.

It wasn’t always this way. In the 1940s, the district’s black population exploded when migrants from the south and World War II veterans came to work at the Hunters Point Naval Shipyard. Some moved to Alice Griffith Public Housing complex, or Double Rock, which was built as military housing in 1962. Others relocated to the Bayview when the Redevelopment Agency took over the Fillmore/Western Addition in the ’60s and ’70s as part of a controversial urban renewal effort.

But when the Navy abandoned the shipyard in 1974, unemployment hit the black community hard. Today, hundreds of the city’s lowest income residents live in Alice Griffith’s crumbling units and endure sewage backups, no heat, cloudy drinking water and leaking ceilings, as they wait for the projects to be rebuilt.

“Generations have been trapped in the silo of public housing and cannot get out, because of lack of opportunity and education, so when we legislate, we need to take that into consideration,” said candidate Malia Cohen, whose grandfather came from Texas to work at the shipyard where he met her grandmother, whose family came from New Orleans.

“My grandfather’s father was a longshoreman. He worked with the infamous Leroy King [a commissioner at the city’s Redevelopment Agency] and he has fantastically vivid stories of racism,” said Cohen, who works for the Federal Reserve Bank of San Francisco, previously served on the executive staff of Mayor Gavin Newsom, and has already raised over $18,000 in the D10 race and qualified for public matching funds.

“My family came here to work hard, they lived on Navy road in the projects, and then they bought a house here. My parents were born here, and we were all public schooled,” Cohen recalled as she took me on a tour of D10 that ended up in Visitacion Valley, an increasingly Chinese-American neighborhood that reflects a district-wide trend.

Census data show that by 2000, Asians were the largest racial group in the district (30 percent), followed by blacks (29 percent), whites (26 percent), and Latinos (19 percent). By 2003, according to the California Urban Issues project, the trend continued. Asians were the largest racial group (32 percent), followed by blacks (27 percent), whites (21 percent) and Latinos (17 percent) of the population.

This means that D10 candidates will have to garner support from more than one ethnic group to win. Over a dozen candidates have already filed papers in the race, but so far there is no clear front-runner.

Also frustrating the prognosticators is that fact that D10 has had the lowest voter turnout in the city, so the winner will also depend on who goes to the polls.

D10 candidate Geoffrea Morris, who is the grand daughter of longtime Bayview activist Charlie Walker, has been knocking on doors and participating in voter registration drives.

“We need new blood,” Morris said

Getting elected will be a complicated equation. Although Bayview’s population was 50 percent African American at the time of the 2000 census, it didn’t turn out the vote. In the 2006 election, only 14,000 of the district’s 37,000 registered voters went to the ballot, and 50 percent were from whiter, richer, and more Asian neighborhoods.

“It’s very important to the future of the city that the ethnicity diversity of the board be maintained and that the African American community have representation,” former Board President and current Democratic Party chair Aaron Peskin told the Guardian.

Maxwell recently told the Guardian that she’s not ready to endorse any D10 candidates yet. “I’m waiting for people to have a better understanding of what this community is, what the common thread running through it is, and how to use rank choice voting,” she told us.

The only candidate who currently holds elected office is BART director Lynette Sweet, who had her answers down pat when we reached her by phone, and even used wording that was eerily similar to Maxwell’s words.

“D10 is a pretty diverse district, but there is only one common thread: the need for economic development,” Sweet told me. “That’s true in Potrero Hill, Portola, Dog Patch and the Bayview. It’s the same mantra: a lot of small businesses need help, and the only way to help them is through economic development. In Potrero Hill it’s about land use. In the Bayview, it’s about the shipyard and better transportation and truancies.”

 

THE COMMON THREAD

District 10 is ground zero for the Lennar’s $2.2 billion plan to develop 10,500 market rate condos at the Shipyard and Candlestick Point. The plan will allegedly create thousands of jobs and new parks, deliver on an historic community benefits agreement that labor groups claim is so “lawyered up” that the developer can’t renege on its promises.

The package is framed as the one and only way to revitalize the southeast’s formerly vibrant economic engine. Indeed, any time anyone tries to slow down the process—to take time to thoroughly read the draft EIR and see if it adequately addresses the impacts of this massive urban reengineering project — a chorus of “no delays” starts up, either from residents of the housing projects desperate to see their homes rebuilt, or the labor contractors who hope to get jobs.

“It’s as if the city is playing checkers, while Lennar is playing three-dimensional chess,” Eric Smith observed.

Lennar has stated that it will contribute $711 million to finance this massive project. The remainder will be leveraged by Mello-Roos bonds, state taxes based on the use and size of a property and intended to raise money for needed services, and tax increment financing, which creates funding for projects by borrowing against future property tax revenues.

The conceptual plan won Maxwell’s backing but environmental groups are critical of the draft EIR.

During DEIR hearing, environmentalists questioned the wisdom and the cost of filling the Bay to build a bridge over Yosemite Slough, and building condos on Candlestick Point state recreation area, the only open major open space in the district.

But the city’s Planning Department also has 20,000-30,000 units of housing in its pipeline. This means that if all these plans get approved in the next decade, they’d account for 80 percent of residential development citywide. And D10’s population could triple, further skewing the district’s already shifting demographics.

In other words, D10 as we know it could become nothing more than a historic relic in a few years, and the next supervisor will play a key role in deciding whether that happens. SFHDC’s Ed Donaldson warns that any supervisor who does not understand the complexity of the city’s largest district can expect a similar recall backlash in future.

“There is no one homogenous voice in the community,” Donaldson said. “The grass-roots organizing that brought about the recall effort was a result of a changing political structure in the area, but is not yet on par with other districts in town. We still allow our politics to be controlled from downtown.”

Fellow candidate Eric Smith warns that the issues—and politics—are complex.

“People were emotional, angry, and desperate because they feel no one listens to them,” Smith said. “That’s part of the problem here; they would rather have a supervisor go down swinging for them, rather than watch one seemingly side with Lennar, PG&E and the mayor on issues contrary to their interests. That’s the terrible irony and one of the biggest problems in District 10. Folks are so mad, they’re willing to do whatever it takes to make them feel they have a voice in the outcome, even if it’s potentially worse.”

Smith cited the sequence of events that culminated last year in the Navy dissolving the community-based shipyard Restoration Advisory Board (RAB), which for years has reviewed technical documents and commented on the Navy’s clean-up proposals. But in December, the Navy made its official decision to disband the RAB, citing dysfunctional behavior and off-topic discussions that got in the way.

“Some of the same folks who were frustrated by the process, tried to send a signal to the Navy that they weren’t being heard and for all their well-intentioned efforts got the RAB dissolved,” Smith said. “I truly feel for them, it’s absolutely heartbreaking, but at times, they can be their own worst enemy.”

One of the looming issues about the shipyard is that the land has been polluted and needs to be cleaned. The shipyard contains radioactive debris from ships towed to the shipyard, after a 90-foot wave washed over them during an atomic test gone awry. The Navy burned 610,000 gallons of radioactively contaminated ship fuel at the shipyard, and workers showered on the shipyard, raising concerns that radioactive materials got into the drains and sewers. And questions have been raised about radiological tests on animals at the yard.

 

LEAKS AND FLOODS

It’s not just the shipyard that’s toxic. Even the buildings that were constructed to house workers 50 years ago are a serious mess.

Realtor Diane Wesley Smith, who grew up in public housing projects, took me on a walking tour of Alice Griffith last week to see conditions that tenants will likely have to endure until at least 2014, if the city sticks to its plan to relocate people into a new replacement unit in the same geographical area, if not the exact same site.

What we found was pretty messed up.

“The water sometimes comes out brown and feels like sand. It’s been like that for a year,” one resident said.

“The water is cloudy, the bath tub isn’t working and the sink keeps stopping up,” said another.

A woman named Silvia showed us how the water from the tap in her elderly mother’s kitchen flows out cloudy and then doesn’t settle properly, like foamy beer.

“The roof’s been leaking for years, the sewage backs up, but they just fixed the lights,” Silvia said. A neighbor named Linda was using her oven as a heater.

“The toilet backs up a lot, and my grandson’s been coughing a lot from asthma,” Linda said.

“Roaches is always a problem,” said a woman named Stormi, dressed in black sweats and a black T-shirt that read, “Can’t knock the hustle.”

“They’re trying,” said Stormi, a member of the Alice Griffith Residents Association, as a couple of Housing Authority trucks pulled up to do repairs.

“They promise that you will not have to leave your unit, but if they try to move us down to the waterfront, well, there’s a reason there’s no housing there, and it’s because the land will flood,” Stormi said.

“If we don’t end up at the table, we’ll end up on the menu,” Wesley Smith warned, as she stopped to chat with a group of young men, who were worried they would pushed out of the Alice Griffith rebuild through the criteria being established.

“Fred Blackwell, the executive director of the Redevelopment Agency, assures me that’s not the case, but Alice Griffith is a Housing Authority property, and empty promises have the potential to be great promises provided they are made in writing,” Wesley Smith said as we walked out of the projects and onto the road where a yellow and black sign announced “flooded” next to Candlestick Point park, where Lennar wants to build.

Malia Cohen expressed concern about Hope SF residents, as we drove through the Sunnydale housing project.

“We have to be diligent and mindful that people are not pushed out,” Cohen said, noting the sweeping views at Gleneagles golf course above Sunnydale, and the value of housing for a golf course community. “When public housing gets taken offline, we must work with Redevelopment and the Housing Authority to make sure no one is changing the rules halfway. We have to make sure the talks and walks line up. We need to be equal partners. We cannot be bulldozed by City Hall.”

Geoffrea Morris is a Calworks employee, at the Southeast Community College facility on Oakdale, which was built to mitigate the city’s expansion of the sewage plant in 1987. She cited concerns about the literacy levels of people who live in the 2200 public housing units that cluster D10. “A lot of people in Alice Griffith don’t even know the dates or when it’s going to be reconstructed,” Morris said. “Folks like to be told stuff like that, but the city gives you a stack of papers. Some will read them, but others rely on folks they think are trustworthy. They need stuff in layman’s terms written on one sheet of paper.”

Morris is a fan of the Internet who posted a community survey online, and made sure every housing project got some literature telling people to get informed. She worries about the digital divide in D10:

“A lot of folks don’t have computers and access to important information,” Morris said. “And let’s talk about the way ‘affordable’ is used to trick people.”

Michael Cohen, Newsom’s top economic adviser, recently stated in a memo that over the expected 15-20 year phased build out, Lennar’s Candlestick-Shipyard development would include, “up to 10,500 residential units, about 32 percent of which (3,345) will be offered at below market rates.”

“But 892 units of this ‘affordable category’ will be sold to folks earning $100,000,” Morris said. “So if you subtract 892 units from affordable unit category, you’re back to 25 percent affordable.”

Candidate Kristine Enea, an attorney and a former RAB member, chairs the India Basin Neighborhood Association, which administers a US EPA grant to hire experts to translate the Navy’s cleanup documents into plain English and comment on them She was frustrated by the Navy’s decision to dissolve the RAB.

“The lack of a forum does nothing to bolster the community’s trust in the cleanup or the redevelopment process,” Enea said.

Enea generally supports the Lennar project, but has concerns about whether it will adequately mitigate increased car traffic, or result in commercial development that benefits her neighborhood.

“India basin is a pocket of Hunters Point right along the shoreline,” Enea said. “Right now, we have no shops or restaurants, no ATM, no groceries, nothing beyond one liquor store and a few industrial businesses.

Potrero Boosters president Tony Kelly told us that District 10 residents can think for themselves. “D10 residents don’t need to rely on corporations to solve their problems,” he said.

“Folks in the eastern neighborhoods came up with a better revitalization plan than what the city proposed and community activists managed to close the power plant, after the city said it was impossible,” Kelly recalled.

And there’s no shortage of good ideas.

Kelly suggested that an urban agriculture center could immediately put low-skilled folks to work by erecting greenhouses on unused land. Smith said the industrial zone could be “incredible eco-park made from sustainable sources.

‘D 10 is the dumping ground for everything, including all the city’s waste,” he said. “We could be a shining example, not just for D 10, but the rest of the state.”

The D 10 candidate line up includes Calloway, Cohen, Donaldson, Smith, Enea: civil rights attorney Dewitt Lacy, Morris, Potrero View publisher Steve Moss; District 7 BART director Lynette Sweet, Wesley-Smith. Bill Barnes, who works for Sup. Michela Alioto-Pier, and Linda Richardson, who was appointed to the Human Rights Commission in 2007 by Mayor Newsom, have also expressed interest in the race.

In such a huge field, name identification will play a major role. Sweet is in office, but BART Board is not a high-profile job and won’t give her a huge advantage.

Cohen has a slight edge right now in that she’s raised $18,505, including $500 from former Newsom flak Peter Ragone, making her the first D. 10 candidate to qualify for campaign financing. The oldest of five girls, Cohen recalls how her mother got laid off from her city job as a school-based mental health worker and then rehired, as part of the city’s budget cuts.

“We felt that pinch and the frustrating games that are played out between the leadership and the rank and file,” she said.

Cohen who worked for Newsom in his first term as mayor, but has since left his administration , said she is uncomfortable at being framed as Newsom’s candidate.

“Because I’m not, but I am one of the few candidates who has seen how the mayor and the Board work—and don’t work—together,” she said.

Moss sees the city’s southeast as a “district in transition.” Over coffee at Farley’s in Potrero Hill, he told me that the southeastern neighborhoods could be “launching pads for environmentally sustainable growth.”

“The district’s been in a frozen period for 30 years, But despite the problems, people are deeply committed to and in love with their community.

“This district is the future of San Francisco and its social fabric—the diversity, income –and its problems are leftovers from the city’s industrial age.”

So, is the SFHA planning to file again, and if so, on what grounds?

Judge tosses Newsom’s political payback suits against Minister Muhammad

For several years, Minister Christopher Muhammad (at lectern) has been trying to get Mayor Gavin Newsom to temporarily stop work at the Hunters Point shipyard, until the children at Muhammad’s school and members of the surrounding Bayview community get asbestos dust-related health tests.

The city’s health department claims there is no health problem related to the dust and that there are no tests available, other than autopsies.
But thanks to Lennar’s failure to properly install and maintain air monitors, there is no data available to prove exactly what levels of dust the community was exposed to, when the developer’s massive grading project began at the shipyard in 2006.

Since then, air monitors at the site have repeatedly recorded exceedances that, the city claims, have triggered protective shutdowns, though often these shutdowns did not occur as fast as the community would like. And the ongoing exceedances have raised additional questions about the cumulative risk to public health and safety of all these dust clouds, where exactly the dust is coming from, and what exactly it contains.

Under new EPA administrator Lisa Jackson, the community’s request for additional assessments of the dust situation is reportedly being reviewed. But meanwhile, Muhammad’s refusal to shut up about the dust, has clearly angered Mayor Gavin Newsom, who recently said, via his spokesperson Nathan Ballard, that he supported a lawsuit that was filed against Muhammad and his group’s school, via the San Francisco Housing Authority, allegedly to recover unpaid back rent.

It was Chronicle columnists Phil Matier and Andy Ross who first asked whether the lawsuit that the San Francisco Housing Authority recently filed against Muhammad and the Nation of Islam’s Center for Self-Improvement, which operates the K-12 school next to the shipyard’s Parcel A in the Bayview, was “pay up or pay back”.

“You decide” the duo wrote on April 1, when they broke the news that the San Francisco Housing Authority had filed a lawsuit against Muhammad, alleging irregularities at the school, shortly after Muhammad and other activists showed up at Newsom’s gubernatorial town halls, asking loud and embarrassing questions about asbestos dust at the shipyard.

But the M&R column has remained deafeningly silent about the outcome of that lawsuit, even though Ross phoned the Nation of Islam’s lawyer Richard Drury minutes after the judge threw out not just one, but all three lawsuits that the SFHA had filed against Muhammad. That was over a week ago, on June 16.

So, does this mean the Chronicle only wants to write about stuff that they can spin to make Newsom look good and Muhammad bad? You decide.

It also turns out that it cost the city very little to file what appears to have been a series of frivolous lawsuits as payback for the Minister’s ongoing questions about asbestos dust: the city used in-house counsel at the Housing Authority, and the City is exempt from filing fees.

Reached by phone, Muhammad’s attorney Drury said he felt all three the lawsuits were “payback” against Muhammad for his attempts to try and get help from Newsom around ongoing issues with dust and asbestos at the shipyard.

“When the Minister didn’t get Newsom’s help, he attended a town hall meeting—and shortly afterwards, the San Francisco Housing Authority sued the Minister for breach of contract, payment of rent and unlawful detained,” Drury said. “In other words, the San Francisco Housing Authority is trying to evict a K-12 school, where 70 percent of the kids were failing in the public school system, and where 80 percent of the center’s graduates go to college.”

Shades of green

When President Barack Obama signed the American Reinvestment and Recovery Act in mid-February, folks across the country were hopeful that the $787 billion stimulus package would help preserve and create decent jobs in their communities.

And in mid-March, when the Obama administration announced that Bay Area social justice activist Van Jones was joining the White House Council on Environmental Quality, advocates for green jobs took it as a sign that Obama shares Jones’ belief that we can fix our nation’s two biggest problems — excessive greenhouse gas production and not enough good jobs for the working class — by creating a green-collar economy.

Jones cofounded Oakland’s Ella Baker Center for Human Rights, which opposes police abuse and promotes alternatives to incarceration, and founded Oakland’s Green for All, which aims to create green-collar jobs in low-income communities. He defines a green-collar job as "a family-supporting, career-track job that directly contributes to preserving or enhancing environmental quality."

"Think of them as the 2.0 version of old-fashioned blue-collar jobs, upgraded to respect the Earth and meet the environmental challenges of today," Jones wrote in his New York Times bestseller The Green Collar Economy: How One Solution Can Fix Our Two Biggest Problems (HarperOne, 2008).

But is Jones’ definition codified into Obama’s Recovery Act? And in San Francisco, where Mayor Gavin Newsom speaks incessantly about green jobs and regularly praises Jones, will the jobs we create be for the people who need them most? And how will that play out in a city where blacks, Latinos and Asians experience higher unemployment, poverty, and incarceration rates than whites, and building construction has stalled, pitting skilled union workers against training program graduates?

Last month, an alliance of community and worker organizations from San Francisco’s working class neighborhoods sent a letter to Newsom outlining concerns about the Recovery Act’s equity, job quality, and transparency requirements.

Antonio Diaz of PODER (People Organizing to Demand Environmental and Economic Rights), Alex Tom of the Chinese Progressive Association, Steve Williams of POWER (People Organized to Win Employment Rights), and Terry Valen of the Filipino Community Center asked Newsom to ensure that ARRA funds would be used to create "green jobs and opportunities primarily for low-income people and people of color" and "high quality jobs with family-supporting wages and benefits, safe and healthy working conditions, and career ladders."

"We ask for your commitment to greater transparency and community input in shaping and monitoring the infusion of ARRA funds for San Francisco’s developing green collar economy," they wrote.

Two weeks later Newsom announced the launching of www.recoverysf.org, a Web site that seeks to track stimpack funds coming to San Francisco. Although the Web site shows that $150 million of the first quarter-billion of formula funding is headed toward infrastructure projects, it does not include estimates of the numbers of green jobs created.

Wade Crowfoot of the Mayor’s Office told the Guardian that the city is focused on ensuring that green jobs are created with these funds and that the City Attorney’s Office is figuring out what is "allowable" under Recovery Act’s guidelines.

On April 3, the U.S. Office of Management and Budget issued a 172-page memo outlining the Recovery Act’s policy goals. The goals included ensuring compliance with equal opportunity laws and principles, promoting local hiring, providing maximum practicable opportunities for small business and equal opportunities for disadvantaged business, encouraging sound labor practices, and engaging with community-based organizations.

"But will all cities include achievable, measurable requirements?" Crowfoot said. "I don’t think so, without federal guidelines."

This lack of specifics, Crowfoot says, has the City Attorney figuring out if San Francisco can include "first source" hiring requirements, in which hiring halls agree to interview graduates from local training programs first. If so, Crowfoot says, the city will seek to leverage existing funding for energy efficiency programs and conduct hire-locally campaigns in low-income communities.

But as Crowfoot notes, although we know that $1.5 million in ARRA funding is coming to San Francisco for weatherizing homes — helping to decrease the energy costs of low-income residents, reduce the city’s energy demands, and increase the number of people hired from the local community to do energy audits and retrofits — we still don’t know how many jobs will be created per project, which is the basic goal of economic stimulation.

"If we spend the dollars, say, on boiler replacement, that’s more equipment and less labor," Crowfoot said. "But the more you hire locally, the more those folks get experience, the more they’ll be well positioned to get jobs in the non-subsidized sector once the stimulus funds are gone."

Acknowledging the tension between laid-off union workers and graduates of apprentice training programs, Crowfoot said, "We are trying to figure out a balance, whereby the community is not shut out, but the unions’ needs are addressed. We want to be careful about how many jobs we say are going to be created. We don’t want to build hope in populations who already have a lot of mistrust in the government."

Michael Theriault, secretary and treasurer of the San Francisco Building and Construction Trades Council, told us that 25 percent of the region’s 16,000 building trades workers are out of work, compared to nearly full employment last year.

In the past, the Northern California Carpenters Regional Council provided CityBuild with instructors and took the lion’s share of the program graduates, Theriault explains. But under present conditions, the Council isn’t keen on another CityBuild cycle.

"I think they should work to sponsor another cycle, but the ball is also in the city’s court," Theriault said, noting that the ARRA-funded weatherization program could soon be offering prevailing union wages ($20 an hour for roofers, $40 to $50 for plumbers and electricians) that could help ease the tension. And then there’s the inconvenient truth that some union members view non-unionized solar panel installers as "scabs," creating another barrier to using green jobs to lift the underemployed.

Mayor Newsom has until June to secure and implement stimpack funding as part of upcoming local budget proposals, a timetable that has Green for All issuing a call for action to ensure that Recovery Act implementation creates green-collar jobs, ensures transparency and accountability, and supports pathways out of poverty.

"This may be the most important opportunity you’ll ever have to bring green-collar jobs to your community," Green For All wrote in a public statement. "But the planning process will be over in the blink of an eye, and your community could miss out. That’s why we’re calling on you to take action now."

Green for All field organizer Julian Mocine-McQueen is scheduled to sit down with Crowfoot this week in an effort to get Newsom to sign his group’s pledge. He said there’s been an expansion of the city’s lighting and refrigeration cooling retrofitting program, starting with small business owners who speak English as a second language. "It’s good," McQueen said. "But it’s not enough."

He believes green job success will depend, in part, on including hiring parameters. "A job in the city’s southeast sector may not pay $70,000 a year, but it would be a huge step toward creating a family-sustaining job," McQueen said, noting that the Obama administration has "to a certain extent" adopted Jones’ definition of green-collar jobs. "I’m not sure that they have codified it," McQueen said. "They have recommendations."

Asked to define green jobs during a recent media roundtable on projected budget deficits, Newsom talked about weatherization and sustainability and plans to expand the city’s training academies before handing the floor to the Office of Economic and Workforce Development’s Kyri McClellan, whom he described as his "green czarina."

McClellan, who describes herself as "the lead cat-herder" of Recovery Act funds, told reporters that San Francisco is expected to receive a quarter of a billion dollars in formula funds in the coming fiscal year, 95 percent of which have been allocated to "shovel-ready" projects that were already queued up under the city’s 10-year capital plan.

During a subsequent board committee hearing, McClellan shared job estimates — 30 jobs from the $11 million Department of Public Works street paving allocation and 250 jobs from the $18 million Housing Authority retrofitting allocation — that raised eyebrows.

McClellan said that OEWD is "moving as quickly as possible to take the dollars we’ve been allocated, get approval from the Board of Supervisors, and get programs up and running."

Observing that the city also has parallel funding for training programs such as CityBuild and a Green Academy, McClellan added that "no one is working harder than Rhonda Simmons." Reached by phone, OEWD’s Simmons said she has been working with San Francisco State University professor Raquel Pinderhughes to identify five job sectors that have "the capacity to grow the greatest number of green jobs."

These include solar installation, energy efficiency, landscaping/public greening, recycling, and green building. "In an economy like this, you have to be competitive," Simmons said. "And almost all the programs that come out of my shop are geared toward low-income to moderate-income folks."

Observing that OEWD is using a $238,000 federal earmark to seed a Green Academy and that will expand the GoSolarSF workforce incentive, compete for a $500,000 EPA brownfield cleanup training grant, and coordinate with the San Francisco Public Utilities Commission to develop "workforce incentive language" for biodiesel reuse program and energy efficiency projects, Simmons notes that it was the unions that helped create CityBuild in the first place, and the city is working to ease current concerns.

"It is our intent as OEWD designs the academy that any training programs must demonstrate that they train individuals for occupations with opportunity for upward mobility," Simmons said, after emerging from a meeting cochaired by Crowfoot and Pinderhughes to help community-based organizations understand green jobs and figure out how to link with the Green Jobs Corps that Pinderhughes set up in Oakland.

Eric Smith runs the Bayview-based Green Depot, a nonprofit that promotes biodiesel use in neighborhoods facing environmental justice issues and ran a $9,000-per intern pilot program with Global Exchange. He worries that administrative costs will chew up much of the stimulus money, citing SFPUC figures that the cost ratio for trainers to interns is about 3:1.

"There is a lot of concern in the Bayview that the money will end up going to consultants and administrators when we have people who are hungry and desperate to work," Smith said.

After two green jobs hearings, Sup. Eric Mar says that he and Sups. Sophie Maxwell and David Chiu have concluded "that unless the board takes action and gives clear guidelines and expectations, green collar job creation will be miniscule."
Noting that Oakland’s Green Job Corps and Richmond’s solar program seem years ahead of San Francisco’s efforts, Mar said his next step will be to talk with labor, environmental groups, businesses, and nonprofits to get a sense of an appropriate structure to prioritize the low-income communities as the main beneficiaries of green-collar job creation. "It’s pretty clear that the [Newsom] administration’s commitment to the numbers of jobs created is pretty small," Mar said. "The community is going to have to push for more."

The budget mysteries

San Francisco’s top budget advisors are predicting that dollars from President Obama’s stimulus package will help reinvigorate the economy over the next three years. But they also warn that the recovery will be slow, and that deficits will be part of political life for some time to come.

The findings are contained in a three-year budget projection report jointly compiled by the Mayor’s Office, the Controller’s Office, and the Budget Analyst’s Office and released to the news media at a hastily announced March 31 roundtable.

During the roundtable, Mayor Gavin Newsom announced that the city faces a "staggering" $438 million budget shortfall in fiscal year 2009-10 — a deficit, financial experts warn, that could balloon to $750 million by fiscal year 2011-12 if cuts and wage concessions aren’t made and structural reform and revenue creating measures aren’t undertaken.

Those future numbers are scary — and a bit apocryphal. Nobody seriously thinks the city will simply ignore this year’s problems and put them off until next year, which means future deficits should be smaller.

But the decisions that will have to be made to keep the red ink under control have been the subject of intense speculation since December, when Newsom announced that the city was facing a deficit equal to cutting every other dollar in the city’s discretionary general fund.

REFORMS? WHAT REFORMS?


In January newly elected Board of Supervisors President David Chiu sought to address the anxiety crashing over the city’s business and labor leaders by inviting stakeholders, including Newsom, to budget meetings at City Hall. But Newsom only agreed to get involved once the youthful board president’s other bright idea — a special election that combined cuts, revenue generating measures, and structural reforms to save as many jobs, programs, and services — was off the table.

And with only two months to go until he submits his 2009-10 budget proposal, Newsom still has not clarified what budgetary reforms he will support this fall, even as the labor unions are being asked to give back $90 million in promised benefits, and the Board of Supervisors gets ready to prepare an annual appropriations ordinance by the end of July.

Newsom did announce last week that he will be is asking some, but not all, departments for 25 percent cuts in the coming fiscal year. Human Services Director Micki Callahan confirmed that 730 pink slips have been sent out since July 2008.

Yet the actual cuts remain a mystery. "I will not be accepting 25 percent cuts from some departments, but from others, I will," Newsom said. "I don’t believe in across-the-board cuts."

Asked which departments he would accept 25 percent cuts from, Newsom told reporters: "You’ll find out when you read my budget."

Within days of Newsom’s statement came news of a deal between the Mayor’s Office and Service Employees International Union Local 1021, the largest city-workers union.

"The goal of this tentative agreement is to protect vital services for San Franciscans, minimize layoffs to employees, preserve the integrity of the collective bargaining agreement, and assist the city with its economic recovery," read a joint public statement.

As of press time, SEIU’s 1021’s Robert Haaland told the Guardian that the two sides are still in negotiations, but confirmed that the union is discussing giving up about $40 million over 16 months, including furloughs and other benefits.

"At the end of the day, our members recognize that they need to share the pain," Haaland said. "The idea is to save jobs and programs."

These givebacks from SEIU are part of the $90 million in concessions the city hopes to get from unions, including those that represent police, firefighters and nurses.

THE PERILS OF TWO-YEAR BUDGETING


As it becomes clear that givebacks and cuts won’t be enough to solve the city’s fiscal crisis, there is talk that the mayor wants to switch to a two-year budget process. Critics say that could represent a massive transfer of power to the Mayor’s Office, unless the Board of Supervisors also gets the power to approve the mayor’s midyear cuts.

"As it is right now, we have power through the Board of Supervisors for one month of the year," said one community organizer, who asked to remain anonymous. "The rest of the time Newsom moves his own agenda through his midyear cuts."

A summary of a March 16 Controller’s Office "budget improvement project" recommends that "the board’s add-back process should require that program restorations and enhancements be reviewed and analyzed by department staff and the board’s budget analyst;" that the "mayor and board should outreach to the general public regarding budget priorities;" and that the "city should adopt a two year budget process consistent with the city’s financial plan."

Sup. Chris Daly said he thinks this year’s grim three-year budget projections make a strong argument against a two-year budget process. "Projections are never right," said Daly, who used to chair the powerful budget committee. "Two years ago we weren’t projecting how bad it was going to be. We can’t do budgets for years out past the current fiscal year. It just doesn’t work."

Sup. David Campos, who sits on the current budget committee, said he wants to see the increased Federal Medical Assistance Percentage (FMAP) funding being provided to the city’s public health and human services departments used to restore proposed cuts, jobs, and services.

Much of the federal money will be earmarked for non-General Fund infrastructre projects at the Municipal Transporation Agency, Housing Authority, airport, and San Francisco Public Utilities Commission.

"We’re saying that if FMAP is coming in so that revenue cuts are not made in the public health area, then why not use these monies to fill gaps, replace cuts, restore funds, preserve programs?" Campos asked.

Campos also wants the mayor and the board to sit down and talk about the November ballot. "I don’t think the budget hole is going to be closed on backs of labor alone," Campos told us. "We’re focused on cuts, elimination of programs, layoffs … But why aren’t we talking about what revenue measures we are putting on the November ballot?

Chiu said he thinks Newsom is committed to some form of tax-based revenue measure. "Just as we can’t solve our budget deficit by taxing our way out of it, so we can’t solve it by cutting our way out of it either," Chiu said. "None of our tax or revenue-generating options would come close to filling 25 percent of that gap."

Noting that business is "more open to taxes that share the burden of who pays," Chiu observed that "it’s important to balance the cuts so it’s not just social services and the health department taking the burden."

The stealth candidate

Ahsha Safai is hoping to be elected to the Board of Supervisors without answering questions about his padded political resume of short-lived patronage jobs, greatly exaggerated claims of his accomplishments, history as a predatory real estate speculator, connections to and coordination with downtown power brokers, shifting and contradictory policy positions, or the many other distortions this political neophyte is offering up to voters in District 11, a crucial swing district that could decide the balance of power in city government.

Safai has refused numerous requests for interviews with the Guardian over the last two months. We’ve even left messages with specific concerns about his record and positions. But our investigation reveals his close political ties to the downtown interest groups that have spent close to $100,000 on his behalf and shows him to be a shameless opportunist who is apparently willing to say anything to achieve power.

There’s much we don’t know about Ahsha Safai, but there’s enough we do know for a consistent yet troubling portrait to emerge.

Safai moved to San Francisco from Washington, DC with his lawyer wife in 2000, and immediately began to ingratiate himself into the mainstream Democratic Party power structure, starting as a legislative liaison with the corruption-plagued San Francisco Housing Authority and joining Gavin Newsom’s mayoral campaign in 2003.

Safai became a protégé of Newsom’s field director Alex Tourk, who was a top Newsom strategist for several years until he abruptly resigned after learning that Newsom had an affair with his wife. With support from Tourk (who didn’t respond to our calls about Safai) and Newsom, Safai held a string of city jobs over the next three years, moving from the Mayor’s Office of Community Development to the Mayor’s Office of Neighborhood Services to the Department of Public Works, all of which he touts on his Web ite, greatly exaggerating (and in some cases, outright misrepresenting) his accomplishments in each, according to those who worked with him. (Few sources who worked with Safai would speak on the record, fearing repercussions from Newsom).

THE CONNECT DISASTER


One project Safai doesn’t mention on his Web site is his work spearheading Community Connect, the most disastrous of Newsom’s SF Connect programs. "It’s the one Connect that the mayor will never talk about," said Quentin Mecke, who participated in the effort, on behalf of nonprofit groups, to create a community policing system. "The whole thing just devolved into chaos and there weren’t any more meetings."

In 2005, Safai and Tourk convened meetings in each of the city’s police precincts to take testimony on rising violence and the failure of the San Francisco Police Department to deal with it. Ultimately Newsom decided to reject a community-policing plan developed through the process by the African-American Police Community Relations Board. That set up the Board of Supervisors to successfully override a mayoral veto of police foot patrols.

"Ahsha’s approach was consistent with the Newsom administration, with folks that talk a good game but there’s no substance behind it," said Mecke, who ran for mayor last year, placing second.

Another realm in which Safai has claimed undeserved credit is on his efforts to save St. Luke’s Hospital from attempts by the California Pacific Medical Center (and CPMC’s parent company, Sutter Health) to close it or scale back its role as an acute care provider for low income San Franciscans.

"When I looked at his campaign material and he says he was a leader who saved St. Luke’s, I thought, ‘Am I missing something here?," Roma Guy, a 12-year member of the city’s Health Commission and leader in the effort to save St. Luke’s, told the Guardian. "Nobody thinks Ahsha has taken a leadership role on this. This is a significant exaggeration from where I sit."

Nato Green, who represents nurses at St. Luke’s within the California Nurses Association, went even further than Guy, saying he was worried about Safai’s late arrival to the issue (Safai wasn’t part of the group that protested, organized, and urged CPMC to agree to rebuild the hospital) and the fact that CPMC appointed Safai to its Community Outreach Task Force as the representative from Distrist 11.

"From our point of view, he is the CPMC’s AstroTurf program, simuutf8g community participation," Green told us. "It’s critical to us that we end up with a supervisor who is independent of CPMC and will go to the mat for what the community needs."

CNA has endorsed Avalos in the District 11 race.

"John was the only candidate in District 11 who came out and spoke at the hearings, attended the vigils, and walked the picket line during the strikes," Green said.


REAL ESTATE SPECULATION


Beyond his association with downtown power brokers and endorsement by Newsom, there are other indicators that Safai is hostile to progressive values. He said in a recent televised forum that he would work most closely with supervisors Carmen Chu, Sean Elsbernd, and Michela Alioto-Pier, the three most conservative members of the Board of Supervisors.

During an Oct. 14 Avalos fundraiser hosted by sustainable transportation advocates Dave Snyder, Tom Radulovich, and Leah Shahum, attendees expressed frustration at Safai’s tendency to pander to groups like the San Francisco Bicycle Coalition, taking whatever position he thinks they want to hear without considering their implications or consistency with his other stands.

"It was a no-brainer for the Bike Coalition to endorse John," Shahum, SFBC’s executive director, said at the event, noting Avalos’ long history of support for alternatives to the automobile.

Avalos, who had been hammered all week by mailers and robocalls from downtown groups supporting Safai, said he was frustrated by the barrage but that "we can fight the money with people.

"Ahsha has done everything he can to blur the lines about what he stands for," Avalos said. "Whoever he’s talking to, that’s who he’s going to be. But we need principled leadership in San Francisco."

One area where Safai doesn’t appear to be proud of his work is in real estate, opting to be identified on voting materials as a "nonprofit education advisor." One of his opponents, Julio Ramos, formally challenged the designation, writing to the Election Department that the label "would mislead voters and is not factually accurate, the term ‘businessman’ or ‘investor’ denotes the true livelihood of candidate Safai."

Safai responded by defending the title and writing, "My dates of employment at Mission Language Vocational School were from August 2007 through February 2008." So, because of his seven-month stint at this nonprofit, voters will see Safai as someone who works in education, even though his financial disclosure forms show that most of his six-figure income comes from Blankshore LLC, a Los Altos-based developer currently building a large condo project at 2189 Bayshore Blvd. that is worth more than $1 million. (That’s the top value bracket listed on the form, so we don’t know how many millions the project is actually worth or how much more than $100,000 Safai earned this year).

But we do know from city records that Safai has personally bought at least three properties during his short stint in San Francisco, including one at 78 Latona Street that he flipped for a huge profit after buying it from a woman facing foreclosure, who then sued Safai for fraud.

The woman, Mary McDowell, alleged in court documents that real estate broker Harold Smith, "unsolicited, came to plaintiff’s residence and offered assistance to her because her homes were in foreclosure … [and said] she would receive sufficient money after sales commissions to reinstate the loans on the four other properties."

The legal complaint said Smith then modified those terms to pay McDowell less than promised and arranged to sell the home to Safai and his brother, Reza. "Plaintiff is informed and believes and thereon alleges that defendants did not promptly list her residence on the multiple listing service to avoid larger offers on the home and conspired with the other defendants to purchase the home at a far less than market price," reads the complaint.

The case was originally set for jury trial, indicating it had some merit. But after numerous pleadings and procedural actions that resulted in the plaintiff’s attorney being sanctioned for failing to meet certain court deadlines and demands, the case was dismissed.
But whatever the merit to the case, records on file with the county assessor and recorder show that Safai and his brother flipped the property for a tidy profit. They paid $365,500 for the place in December 2003 — and sold it two year later, in December 2005, for $800,000.
Labor activist Robert Haaland told us that Safai can’t be trusted to support rent control or the rights of workers or tenants: "At the end of the day, he’s a real estate speculator."

Newsom’s Sunshineless Solar

Mayor Gavin Newsom wants to be known as the Green Mayor. But he could go down in history as the mayor who secretly diverted public money from large municipally owned solar installations to subsidize privately owned solar panels.

Since January, Newsom has tried to kick start two questionably financed solar programs.

The first plan involved raiding $50 million from a seismic safety loan fund. That idea got shelved in the New Year, when the Board of Supervisors asked why these funds couldn’t be used to seismically retrofit affordable housing units, rather than subsidize private solar installations?

The second plan is involved diverting $3 million from the Mayor’s Energy Conservation Account, which was set up in 2001 to increase energy efficiency and reduce cost of energy use.

Since then, $39 million has been allocated to MECA with $10 million allocated in the current fiscal year, 2007-2008.
These monies come from the General Fund and are under the purview of the San Francisco Public Utilities Commission.

Deputy Controller Monique Zmuda says so far all projects funded by MECA have benefited city facilities and PUC facilities.

“These funds have not been used to my knowledge to subsidize or loan funds to privately owned energy conservation projects,” Zmuda told the Guardian.

MECA funded projects include solar panels at Moscone, the replacement of refrigerators at the San Francisco Housing Authority, solar projects at MUNI, a new heating system at the central plant of San Francisco General Hospital, Solar projects at San Francisco Airport, a Solar project at North Point, and Port Energy Efficiency.

But under the Mayor’s Solar Energy Incentive Program, these public monies would be used to help subsidize the installation of solar panels on privately owned buildings and homes.The program places a $10,000 cap on the subsidizing of solar on private property.

Crime cameras for the defense

EDITORIAL We’ve always been dubious about San Francisco’s crime cameras. Filming everyone who passes through a public space creates severe civil liberties problems. There are real First Amendment issues. And as far as we can tell, the spy cams don’t work very well: none of the 178 cameras on Housing Authority property have ever led to an arrest in a homicide case. Chief Heather Fong told the Police Commission on Feb. 6 that her officers have requested footage nearly 80 times but only twice was it at all useful.

From the first days when the city began talking about installing the cameras, the American Civil Liberties Union and others pointed out that all the electronic surveillance on high-crime street corners would do was drive crime to other places. The commission has mandated that the cameras be turned off during political demonstrations, and some critics, including commissioner David Campos, are watching very closely to see if all of this intrusive electronic surveillance is making the city any safer.

But if we’re going to have crime cameras, they ought to be used to protect the innocent.

As G.W. Schulz reports on page 16, the San Francisco Public Defender’s Office has an interest in using the footage. Last August two young African American men were arrested and charged with robbing a pair of airline workers at the corner of 14th Street and Mission. The alleged robbers insisted they hadn’t been at that corner; in fact, they said, they were two blocks away, at 16th Street and Mission, the entire time.

That should have been easy to prove: there are cameras at 16th Street and Mission. But the city’s Department of Emergency Management refused to turn over the video footage to the public defender. Only by chance and the intervention of a conscientious police inspector was the lawyer for the two men able to get the tapes — which proved that the young men, who faced long prison sentences, were entirely innocent.

Public Defender Jeff Adachi says there are at least a dozen other examples of incidents when the cameras could have proved one of his clients innocent — but the local law enforcement authorities won’t give up the pictures.

That’s crazy. If the cameras can be used for prosecution, they ought to be available to lawyers for people who want to establish an alibi. There’s little or no risk here: defense lawyers are officers of the court, sworn to protect confidential evidence, and they are routinely given access to sensitive law enforcement information. The entire principle of a fair trial requires that the defense have as much opportunity to prove innocence as the prosecution does to prove guilt — and in most cases all of the state’s evidence has to be turned over to the defense. If cops and prosecutors can see the city’s crime-camera tapes, why can’t the other side?

Sup. Gerardo Sandoval, a former public defender, has introduced legislation that would allow defense lawyers access to the tapes; it’s a sensible, practical measure that ought to win easy approval. But Kevin Ryan, the Republican former United States attorney who runs Mayor Gavin Newsom’s office of criminal justice, is trying to scuttle Sandoval’s bill. This is exactly the sort of thing we were worried about when Newsom gave that job to an old-fashioned law-and-order type.

Newsom needs to show his cards on this issue. Does the mayor really think the cameras should be used only to lock people up and never to set them free? That would be an astonishing stance for a San Francisco mayor. Instead of leaving this to his aides, Newsom needs to come out in support of Sandoval’s bill and give Ryan a little primer on justice, San Francisco–style.

Sharing the Panopticon

When two airline workers were robbed at 14th and Mission streets last August, the victims called 911 and described their attackers to the dispatcher as a pair of African American males.

At the time, several groups of people stood two blocks away at the always manic intersection of 16th and Mission streets, a high-crime area where the city installed four public surveillance cameras as part of an ongoing pilot project that began in 2005.

Police nabbed two suspects there whom they believed fit the description, and the victims later identified the duo as their attackers. Case closed. Except for one problem: the suspects claimed they were standing at 16th and Mission streets the whole time and never ventured two blocks away, to where the robbery occurred.

So a deputy public defender, Eric Quandt, tried to obtain footage from the city’s controversial public safety cameras to confirm their story. He was denied access to it by the San Francisco Department of Emergency Management because, according to the city’s Administrative Code, only police officers with a written request can review the recordings.

Other government agencies must get a court order, and since the recordings are held by the city for no more than seven days, by the time defense attorneys realize crucial evidence might exist, it’s likely to be long gone.

Mayor Gavin Newsom’s expansion of public surveillance cameras across the city has been the subject of regular criticism from privacy advocates who say no substantial evidence exists that they reduce crime or provide valuable evidence to prosecutors. But few imagined Big Brother could serve as an alibi proving someone’s whereabouts when police placed the wrong suspect at the scene of a crime.

Quandt managed to get the footage in time after appealing to a police inspector, and 23-year-old Neil Butler and 21-year-old Robert Dillon, who had served 70 days in jail, were freed. However, the city’s elected public defender, Jeff Adachi, said there have been almost a dozen or so other instances when his office believed surveillance footage from the cameras could refute a prosecutor’s claims, but city officials have barred PDs from accessing it.

"These two men would have faced decades in prison," Adachi told the Guardian, "so I find it shocking that law enforcement would object to the defense obtaining these tapes. It has to be a two-way street."

"[City officials] act as if they have a proprietary right over the footage," added Rebecca Young, the managing attorney for Adachi’s felony unit. "We are officers of the court. We should not have to deal with bureaucratic red tape to access and review the footage."

Few cities in the United States have rules in place reguutf8g the use of surveillance footage to begin with, so determining procedures for how defense attorneys might use the cameras to free innocent people once again puts San Francisco on the cutting edge of public policy.

After learning about the robbery case last August, Sup. Gerardo Sandoval decided defense lawyers need access to the recordings if they could be used as evidence to free people wrongfully charged with crimes.

Sandoval’s legislation would require the city to preserve the footage for 30 days instead of seven, giving defendants more time to access the footage. Their lawyers would only need to submit a written request to the Department of Emergency Management, which controls the tapes.

But Newsom’s newly appointed top criminal-justice aide, Kevin Ryan, and the mayor’s chief of staff, Phil Ginsburg, want to kill the legislation, claiming it would cost the city too much money and could potentially compromise ongoing criminal investigations by exposing witnesses or confidential informants who appear in the footage.

"It’s safe to say that they tried to derail the legislation," Sandoval told the Guardian.

Ryan, you may recall, is the former US attorney for the Northern District of California who attempted to define his law enforcement career by prosecuting the steroids scandal in major-legal baseball and later the stock options backdating imbroglio that consumed Silicon Valley.

His last major imprint on the public, however, came when the White House ousted him from the Justice Department along with seven other chief federal prosecutors. While his colleagues were said to be let go because they weren’t fully cooperative with the GOP’s political agenda, it was reported that Ryan was asked to resign because of mounting criticism that he’d poorly managed his office and alienated staffers, despite being an eager loyalist of President George W. Bush.

After that, Ryan worked briefly in the private sector before Newsom surprised the city at the beginning of the year by making him director of the Mayor’s Office of Criminal Justice. While a prominent San Francisco Democrat making a Republican devotee his top aide on issues related to crime raised eyebrows, Ryan’s inaugural act in that capacity epitomizes the outlook of a conservative law enforcement official.

Sandoval has attached to his ordinance a string of amendments to satisfy law enforcement, such as instituting punishments for defense lawyers who publicly disclose videos and allowing the district attorney and the Police Department 180 days to review footage and block its release if it’s deemed too sensitive for any reason.

However, the supervisor says he’s still not sure that Newsom, through his new conservative crime-fighting proxy, will accept making a traditional tool of law enforcement the new weapon of public defenders who serve indigent criminal suspects.

"I got the impression from Ryan that he outright opposed it," Adachi said. "But I’m not sure where the mayor stands on it."

Ryan and mayoral chief of staff Ginsburg did not return calls for this story, nor did the mayor’s press spokesperson, Nathan Ballard, respond to a detailed e-mail.

But Ryan has already shown a willingness to flout Newsom’s caution on the cameras. After the Feb. 6 Police Commission meeting, Ryan told the San Francisco Chronicle that police should be permitted to monitor the city’s surveillance cameras in real time to identify crimes about to occur or already in progress.

When the safety cameras were first launched, however, Newsom made a major concession to privacy advocates, the American Civil Liberties Union of Northern California most notable among them, by prohibiting law enforcement officials from watching the cameras live, in part to protect against potential voyeurism or racial profiling.

Ryan’s desire to expand the camera program is "all the more reason to make sure there’s a process in place," Adachi said, for defense lawyers to obtain the footage.

The Police Commission, meanwhile, has made it clear that the footage should not be widely available as public records and the cameras ought to be shut off during political demonstrations to protect First Amendment rights and keep federal agents from using them to target undocumented immigrants.

"If the public defender or a defense lawyer needs it, to me that’s an appropriate use of the information," police commissioner David Campos told the Guardian. "The concern should be: is there any way to keep the feds from getting this footage? We don’t have a way of doing that right now."

San Francisco launched its surveillance program in mid-2005 with two cameras outside public housing tracts in the Western Addition. Two and a half years later, 74 cameras are spread across the city in 25 locations, even though city officials were still calling this a pilot project as recently as this month.

The city was supposed to provide the Board of Supervisors and the Police Commission with a report by last year that evaluated how well the cameras were performing, but city administrator Ed Lee has missed several deadlines, and now it’s not due until March.

Jennifer King, a research analyst for the University of California at Berkeley’s Samuelson Law, Technology and Public Policy Clinic, is leading the study and says it’s one of only two that she’s aware of taking place in the US at this time.

A preliminary report done by the Berkeley team will only include an analysis of crime statistics, but a second study will involve comparing camera locations with control sites that are the same size and have similar demographics and crime profiles, because "there could have been changes in the background crime rate citywide that had nothing to do with the cameras," King told the Guardian.

In the meantime, Police Chief Heather Fong told the commission Feb. 6 that inspectors had requested footage nearly 80 times but in only two instances was it "useful in a prosecution."

At another public meeting last year, an official acknowledged that of the 178 cameras controlled by the federally subsidized San Francisco Housing Authority, none has ever led to an arrest in a homicide case, despite the fact that a large percentage of the city’s violent crime occurs in public housing developments.

Even Sandoval’s not convinced of the cameras’ efficacy: "We have to do everything we can to make sure everyone has fair access to the cameras…. But I’m fairly certain that the cameras really are just an intrusion into our privacy and the risk greatly outweighs any benefit."

Team Newsom’s $$$ value. More or less.

Before we get to the juicy details of how much money Team Newsom is taking home, it’s worth noting that Mayor Gavin Newsom spent last Friday handing out draft copies of the report in which these figures can be found–a report that Budget Analyst Harvey Rose drew up at Sup. Jake McGoldrick’s request to figure out the impacts that staff changes within the Mayor’s Office would have on the City’s budget–changes Newsom announced Jan. 4.

It’s also worth noting that Rose didn’t know that Newsom Chief of Staff Phil Ginsburg was standing around last Friday telling the press that his report was a piece of “bull-.”, until the press called him later that same day and asked him for a comment.

And that all this unauthorized report distribution and undefended “bullshit” calling was happening just five weeks after Newsom announced that the City is facing a $229 million budget deficit and that therefore the city must implement an immediate hiring freeze and across-the-board departmental budget cuts.

Unlike Sups. Chris Daly or Aaron Peskin, who are more typically the targets of the mayor’s famously snippy wrath, Rose isn’t a politician, but a widely respected analyst, and so Team Newsom could hardly accuse him of “political theater”.

Instead, Ginsburg told the Chronicle that, “The budget analyst has no understanding of how salaries work in this city,” while Newsom made the vague claim that, “It’s personal.”

But however much they tried to put a negative spin on Rose report, Team Newsom could not deny that it paints an unflattering picture of the Mayor’s Office as a place that is using over $1 million from other departmental budgets to make new hires and increase the salaries of staff that are assigned to the Mayor.

As Rose reports “The Mayor’s practice of including positions assigned to the Mayor’s Office, but funded in the budgets of the Municipal Transportation Agency, the Human Services Agency and the Planning Department Budgets, understates the Mayor’s Office’s budgeted and actual costs for such positions, while such costs are overstated in those three other Departmental budgets.”

Rose’s report found that

a) The estimated total increased annual salary and fringe benefits costs of the 17 newly-appointed department directors to replace existing directors, and the ten Mayor’s Office staff appointments, two of which are completely new functions, are $553,716.

b) Other City departments fund about $1.34 million in annual salary and fringe benefits for ten positions assigned to the Mayor’s Office, including the mayor’s new climate change director Wade Crowfoot and new Homelessness Policy Director Dariush Kayhan.

c) The costs of appointing Ed Harrington, as General Manager of the SF Public Utilities Commission, Ben Rosenfield as Controller, Mirian Saez, as Interim Director of the San Francisco Housing Authority, and Jordanna Thigpen, as Acting Director of the Taxi Commission have yet to be announced.

d) Terminating Susan Leal, General Manager of the SF PUC, without cause, as is Newsom’s stated intention, will add a further $401,392 to City costs.

e) the mayor’s Office is also recruiting for a replacement to the CityBuild Director, at a cost of $144,596.

In face of these dicey accounting practices, Rose suggests that the Board of Supervisors rescind funding for positions assigned to the Mayor’s Office but included in other departments’ budgets, and the cost of these positions, estimated to be $898, 718, could then come from the Mayor’s General Fund monies.

The Board, says Rose, could also eliminate MTA funding for Mayor’s Office positions which do not directly benefit the MTA’s core functions. Those positions could then be funded, Rose reports, to the tune of $240,943, from the Mayor’s Office’s General Fund monies.

Rose’s report also notes that, “The newly appointed Climate Protective Initiatives Director is a new function unrelated to the MTA’s Safety and Training Unit,” even though the position if currently being funded through monies set aside for that unit.

How to save the Housing Authority

OPINION After repeated media attention to the myriad problems at the San Francisco Housing Authority, Mayor Gavin Newsom asked the agency’s director, Gregg Fortner, to resign. An interim director, Mirian Saez, was appointed to fill his shoes until a national search is conducted to find a permanent replacement. The mayor has announced replacements for two of the seven commissioners; one of the new appointees, Dwayne Jones, is a senior Newsom staffer.

As an affordable-housing advocate who works with residents of public housing, I am overjoyed at the prospect of change at the agency. No matter who is chosen to be the new director, a few key changes should be seriously considered for the city’s largest low-income-housing provider. Here are some suggestions:

1. Appoint commissioners who get it and care. The mayor could have made sweeping changes after he asked the SFHA commissioners to submit letters of resignation. Instead, he used the opportunity to appoint someone who is on his payroll. As long as political connections continue to trump experience, understanding, and compassion, tenants will suffer. What about having a public process in which residents and the community can nominate candidates? How about sharing the power to appoint housing commissioners with the Board of Supervisors, as is done with some other city commissions?

2. Listen to the residents, damn it! While it is refreshing to see the mayor look for solutions to the rampant problems at the SFHA, a panel of national experts is hardly necessary. The best experts are right here. They are residents, and they are clamoring to have their voices heard. Conduct a local survey, have regular open meetings, encourage the formation of resident councils, work with service providers and community groups that reach out to residents, and allow for resident participation as much as possible.

3. Talk among yourselves. The same lessons we learned after Sept. 11 and Hurricane Katrina apply to this disaster as well. City agencies that serve public housing residents are often unaware of the major issues at public housing developments. The Departments of Building Inspections and Public Health, for instance, should be monitoring conditions and reporting to the mayor and the supervisors. The Mayor’s Office of Housing should be working closely with the Redevelopment Agency, the Office of Community Development, and the Human Service Agency as they plan for the demolition and rebuilding of distressed projects. City officials and agencies shouldn’t have to pull teeth to get basic information from the SFHA.

4. Tell Nancy Pelosi and her colleagues to fight like hell. Whoever leads the Housing Authority in the future will always have a defense against charges of not addressing poor conditions because Congress keeps hacking away at the Department of Housing and Urban Development budget. We have powerful congressional representation in San Francisco; let’s push harder.

5. Step up to the plate to provide local resources to improve public housing. As hard as we fight to leverage more federal funds, it is nearly certain that the SFHA will still be severely underfunded. We can no longer rely solely on federal funds to house our lowest-income residents. A commitment to creative and innovative local funding solutions must continue or we will see an increase in the exodus of African American families, which the mayor claims to be committed to curbing.
