The battle for District 6

The race to replace Chris Daly — the always progressive, sometimes hotheaded supervisor who has dominated District 6 politics for almost a decade — is becoming one of the most important battles of 2010, with the balance of power on the board potentially in play.

Through whatever accident of politics and geography, San Francisco’s even-numbered districts — five of which will be up for election next fall — haven’t tended to fall in the progressive column. Districts 2 (Marina-Pacific Heights) and 4 (Outer Sunset) are home to the city’s more conservative supervisors, Michela Alioto-Pier and Carmen Chu. District 8 (the Castro) has elected the moderate-centrist Bevan Dufty, and District 10 is represented by Sophie Maxwell, who sometimes sides with the progressives but isn’t considered a solid left vote.

District 6 is different. The South of Market area is among the most liberal-voting parts of San Francisco, and since 2000, Daly has made his mark as a stalwart of the board’s left flank. And while progressive are hoping for victories in districts 8 and 10 — and will be pouring considerable effort and organizing energy into those areas — Daly’s district (like District 5, the Haight/Western Addition; and District 9, Mission/Bernal Heights) ought to be almost a gimme.

But the prospect of three progressive candidates fighting each other for votes — along with the high-profile entry of Human Rights Commission director Theresa Sparks, who is more moderate politically — has a lot of observers scratching their heads.

Is it possible that the progressives, who have only minor disagreements on the major issues, will beat each other up and split the votes enough that one of the city’s more liberal districts could shift from the progressive to the moderate column?

A FORMIDABLE CANDIDATE


A few months ago, District 6 was Debra Walker’s to lose. The Building Inspection Commission member, who has lived in the district for 25 years, has a long history on anti-gentrification issues and strong support in the LGBT community.

Jim Meko, who also has more than a quarter century in the district and chaired the Western SOMA planning task force, was also a progressive candidate but lacked Walker’s name recognition and all-star list of endorsements.

Then rumors began to fly that school board member Jane Kim — who moved into the district a few months ago — was interested in running. Kim has been a leading progressive voice on the school board and has proven she can win a citywide race. She told me she’s thinking seriously about running, but hasn’t decided yet.

Having Kim in the race might not have been a huge issue — in District 9 last year, three strong progressives competed and it was clear that one would be the ultimate winner. But over the past two weeks, Theresa Sparks has emerged as a likely contender — and if she runs, which seems more than likely at this point, she will be a serious candidate.

Sparks picked up the kind of press most potential candidates would die for: a front-page story in SF Weekly and a long, flattering profile in San Francisco magazine, which called her "San Francisco’s most electrifying candidate since Harvey Milk." Sparks does have a compelling personal tale: a transgender woman who began her transition in middle age, survived appalling levels of discrimination, became a civil rights activist and now is seeking to be the first trans person elected to the San Francisco Board of Supervisors.

She has experience in business and politics, served on the Police Commission, and was named a Woman of the Year by the California State Assembly (thanks to her friend Sen. Mark Leno, who would likely support her if she runs).

"Anyone who knows Theresa knows that she is smart, a formidable candidate, can fundraise, and will run a strong race," Robert Haaland, a trans man and labor activist who supports Walker, wrote on a Web posting recently.

She’s also, by most accounts (including her own) a good bit more moderate than Walker, Meko, and Kim.

LAW AND ORDER


Sparks doesn’t define herself with the progressive camp: "I think it’s hard to label myself," she said. "I try to look at each issue independently." Her first major issue, she told me, would be public safety — and there she differs markedly from the progressive candidates. "I was adamantly against cuts to the police department," she said. "I didn’t think this was a good time to reduce our police force."

She said she supported Sup. David Campos’ legislation — which directs local law enforcement agents not to turn immigrant youth over to federal immigration authorities until they’re found guilty by a court — "in concept." But she told me she thinks the bill should have been tougher on "habitual offenders." She also said she supports Police Chief George Gascón’s crackdown on Tenderloin drug sales.

And she starts off with what some call a conflict of interest: Mayor Gavin Newsom just appointed her to the $160,000-a-year post as head of the HRC, and she doesn’t intend to step down or take a leave while she runs. She told me she doesn’t see any problem — she devoted more than 20 hours a week to Police Commission work while holding down another full-time job. "I don’t know why it would be an issue," she said, noting that Emily Murase ran for the school board while working as the director of the city’s Commission on the Status of Women.

But some see it differently. "It would be as if the school superintendent hired someone to a senior job just as that person decided to run for school board," Haaland said.

Sparks’ election would be a landmark victory for trans people. For a community that has been isolated, dismissed, and ignored, her candidacy (like Haaland’s 2004 run in District 5) will inspire and motivate thousands of people. And it’s a tough one for the left — opposing a candidate whose election would mean so much to so many members of one of the city’s most marginalized communities could be painful. "A lot of folks will say that the progressives will never support a transgender candidate," Haaland noted.

But in terms of the city’s geopolitics, it’s also true that electing Sparks would probably move District 6 out of the solidly progressive column.

"If we lose D6, it’s huge," Walker noted. "This is where most of the new development is happening, where law-and-order issues are playing out, where we can hope to save part of the city for a diverse population."

More than that, if progressives lose District 6 and don’t win District 8, it will be almost impossible to override mayoral vetoes and control the legislative agenda. And that’s huge. On issue like tenants rights, preventing evictions, controlling market-rate housing development, advancing a transit-first policy — and raising new revenue instead of cutting programs — the moderates on the board have been overwhelmingly on the wrong side.

Kim, for her part, doesn’t want to talk about the politics of the 2010 elections — except to say that she’s thinking about the race and will probably decide sometime in the next two months. But she agreed with my analysis of how any left candidate should view this election: if she’s going to enter, she needs to present a case that, on the issues that matter, she’d be a better supervisor than either of the two long-term district residents with strong progressive credentials already in the race.

"I don’t have an answer to that now," Kim told me. "And when I make my decision, I will."

LAFCo to SFPUC: Hurry it up already!

Supervisor David Campos sent a clear message at the Local Agency Formation Commission (LAFCo) meeting on Jan. 23, emphasizing that he was eager to move beyond the delays that have hindered progress on Community Choice Aggregation. Commissioners Michael Bornstein and Ross Mirkarimi — who represents District 5 on the Board of Supervisors — echoed his concerns, along with an array of community members who turned out to speak during the public-comment session. Meanwhile, a few members of the public warned that further delays might amount to missing the boat on federal funding for alternative-energy programs, which the Obama administration is expected to make available in the near future.

Campos, who represents District 9 on the Board of Supervisors, is also the newest LAFCo commissioner. The city agency is charged with monitoring and advising the San Francisco Public Utility Commission’s efforts to develop and implement a Community Choice Aggregation program, which was mandated in 2004 by the Board of Supervisors to help ensure the “provision of clean, reasonably priced, and reliable electricity.” A CCA program would allow the city and county of San Francisco to become its own wholesale power purchaser for citizens. The plan includes targets for purchasing power generated from renewable resources such as wind and solar, with a goal of 100 percent clean energy by 2040. But the process of getting CCA off the ground has been moving along at a snail pace.

From the scene at Rassela’s on Fillmore you might assume that the whole world, or at least the whole city, is celebrating tonight.

The party is ostensibly for the re-election of Supervisor Ross Mirkarimi in District 5 but I could not find him amid the loud, crowded rooms. Supervisor Mirkarimi’s victory was never really debated, and either way, a certain president-elect from Illinois stole the show.

It is truly a historic night here in San Francisco. Happy citizens of all races, creeds, and income brackets have come together…to dance. As I write this, a distinguished looking, white haired businessman is getting down on the dance floor with a woman who appears to be homeless.

It is truly a day of unity for the city. Party hard san Francisco, for tomorrow we go to work.

A real plan for safety in the Mission

OPINION When I heard the news that Jorge Hurtado was shot and killed in the Mission District, I was doubly stunned. Not only was the 18-year-old my neighbor, he was shot on the same corner where Erick Balderas was killed a year ago.

Eleven years ago, Erick was a student in the fourth grade class I taught at Paul Revere Elementary in Bernal Heights. In fact, three of my former students have been murdered in the city in the last two years. None were gang members — and none of their attackers have been caught.

Violent crime in the Mission is on a huge upswing; the homicide rate is on track to double what it was a year ago. In just a few weeks there have been six killings in the Mission. It’s a tragedy that affects everyone: kids, parents, teachers, business leaders — the entire community.

That community has begun to take matters into its own hands after receiving no commitments from the Mayor’s Office. It’s going to take two things to overcome violence in the community: community policing to better prevent and solve crimes, and engagement around social problems that promote violence.

I am glad that Capt. Stephen Tacchini of the Mission Police Station will receive more reinforcements in response to these recent shootings. But it’s not enough. Beat cops get to know the people in the neighborhood, and vice versa. But it has to be done the right way: the officers have to be trained appropriately so that police and people in the community can feel comfortable interacting with one another. Especially in a neighborhood like the Mission, cultural competency training is critical.

In Chicago, the city creates incentives for police to live in the communities they patrol. We’re exploring new housing options for teachers in the school district, and we should expand the discussion to include police officers as critical members of the community.

We don’t need to go as far as Chicago, though, to find ideas that work: in District 5, Sup. Ross Mirkarimi has pushed for foot patrols (the supervisors overrode a mayoral veto last year to make it happen). He has also gathered everyone around the same table — nonprofits, police brass, community leaders, city agency heads, small business owners — and these stakeholders have collectively worked on the problems. Because of these strategies, District 5 has seen a huge reduction in violence.

We also have to make sure that the organizations working with youth are engaged with one another, not competing for resources at the expense of getting the job done. There is $12 million available citywide for violence prevention, much of it spent in the Mission. But we’re not seeing results. Duplication of services, as well as filtering out the really troubled youth who are most at-risk, have diminished the impact of our CBO’s hard work.

I’ve already proposed that a Beacon Program be opened at O’Connell High School, which is near the heart of the violence. It would give kids a safe place to drop in as late as 2 a.m., where they could be referred to counseling services, if necessary.

Candlelight vigils are one way to help a community mourn their loss and begin to heal. But we won’t stop this endless cycle with vigils alone. Prevention needs to be our unified goal. *

Follow the money: downtown and the landlords are trying to take over the Board of Supervisors.

It’s not surprising. For the past eight years, the progressives have had enough of a solid majority on the board to prevent Mayor Gavin Newsom from putting some of his worst plans in place and to propose — and often implement — a much better agenda.

This board brought us the living wage ordinance and the universal health care program. This board is moving to solve the budget crisis with taxes on wealthy property owners and big law firms. This board isn’t about to approve an Eastern Neighborhoods Plan that turns the city entirely over to the developers. This board supports public power and renewable energy, and is willing to go up against Pacific Gas and Electric Co.

In fact, these past few years have marked the first time in a generation or more that downtown hasn’t controlled both the Mayor’s Office and the board. And the big boys don’t like it a bit.

They know they can’t defeat Sup. Ross Mirkarimi in District 5, and that they can’t stop a progressive candidate from winning in District 9. But they are going full bore, with huge bags of money, to try to get their toadies elected in Districts 1, 3, and 11. This is a real threat, folks. We could lose the board in November. We could lose rent control; that’s what the landlords want.

Sarah Phelan and Ben Hopfer have put together a beautiful chart in this issue that shows how all this is happening. Essentially, a few big players and their political action committees have amassed hundreds of thousands of dollars and are using that money to try to smear supervisorial candidates John Avalos, Eric Mar, and David Chiu. There are independent committees doing hit pieces. There is money pouring directly into the campaigns of downtown candidates. There’s PG&E money. It’s a sewer of nasty campaign cash, all aimed at making sure that three solid progressives don’t win.

The San Francisco Tenants Union has a study showing that big landlords, developers, and real estate lobbyists have poured more than $100,000 into a real estate slate made up of Sue Lee in D1, Joe Alioto in D2, and Ahsha Safai in D11. Almost $60,000 went to Alioto alone; that’s a third of his total money.

You can see where that money’s going if you live in the Excelsior, North Beach, or Richmond districts. It’s going for misleading, nasty hit pieces. One piece attacks Mar for supposedly preventing neighborhood kids from attending neighborhood schools (on the School Board, Mar, like every other sensible board member, has refused to allow the schools to be resegregated, which is what the "neighborhood schools" movement is talking about). Another attacks Avalos for being too close to Sup. Chris Daly (sure, he worked for Daly and they share some political views. But if you meet Avalos, you realize he and Daly have radically different temperaments).

All this is part of a larger downtown strategy. If this crew can’t win those three races in November, I guarantee they’ll try to amend or repeal district elections in the next two years. They’re well-funded, they’re serious, the stakes are high — and they have no problem fighting dirty.

DENNIS HAYASHI


A public interest lawyer with a focus on civil rights, Dennis Hayashi has worked for years with the Asian Law Caucus. He was co-counsel in the historic case that challenged Fred Korematsu’s conviction for refusing to report to a Japanese internment camp during World War II. He’s run the state’s Department of Fair Employment and Housing and was a civil rights lawyer in the Clinton administration. He has spent much of his life serving the public interest and would make a fine addition to the bench.

Berkeley mayor

TOM BATES


Tom Bates was a stellar member of the State Assembly once upon a time, and is seen in many quarters as a progressive icon in the East Bay. But he’s been a bit of a disappointment at times as mayor. He’s been dragging his feet on a Berkeley sunshine ordinance, he’s way too friendly with developers, and he helped gut the landmarks-preservation law. He’s supported some terrible candidates (like Gordon Wozniak).

Still, Bates has made some strides on workforce housing and on creating green jobs. He’s fought the University of California over its development plans. And he’s far, far better than his opponent, Shirley Dean.

Dean is even more pro-development than Bates. She’s terrible on tenant issues and won’t be able to work at all with the progressives on the council. We have reservations with Bates, but he’s the better choice.

Berkeley City Council

District 2

DARRYL MOORE


Moore came to the Berkeley City Council with a great track record. We endorsed him for this post in 2004, as did the Green Party. He supports instant-runoff voting and a sunshine ordinance. But he’s been awfully close to the developers and brags that he’s proud to have a high rating from the Berkeley Chamber of Commerce. His opponent, John Crowder, isn’t a serious contender, so we’ll go with Moore, with reservations.

District 3

MAX ANDERSON


Max Anderson is one of two real progressives on the council (the other is Kriss Worthington). Anderson, an ex-Marine, was one of the leaders in the battle against Marine recruitment in Berkeley and has been strong on environmental issues, particularly the fight against spraying the light brown apple moth. He deserves another term.

District 4

JESSE ARREGUIN


Dona Spring, who ably represented District 4 and was a strong progressive voice on the council, died in July, leaving a huge gap in Berkeley politics. The best choice to replace her is Jesse Arreguin, who currently works in the office of Councilmember Kriss Worthington.

Arreguin is the chair of the Rent Stabilization Board and has served on the Zoning Appeals Board and the Downtown Area Plan Advisory Committee, where he out-organized the moderates and pro-development sorts. He supports sustainable, community-based planning and would be an excellent addition to the council

District 5

SOPHIE HAHN


This is a fairly moderate district, and incumbent Laurie Capitelli is the clear favorite. But Capitelli has been terrible on development issues and is too willing to go along with the mayor on land use. Sophie Hahn, a lawyer, is a bit cautious (she didn’t like the city’s involvement in the Marine recruitment center battle), but she’s a strong environmentalist who’s pushing a more aggressive bicycle policy. And she’s a big supporter of local small businesses and wants to promote a "shop local" program in Berkeley. She’s the better choice.

District 6

PHOEBE ANN SORGEN


Incumbent Betty Olds — one of the most conservative members of the city council — is retiring, and she’s endorsed her council aide, Susan Wengraf, for the seat. It’s not a district that tends to elect progressives, and Wengraf, former president of the moderate (and often pro-landlord) Berkeley Democratic Club, is the odds-on favorite.

We’re supporting Phoebe Ann Sorgen, who is probably more progressive than the district and lacks experience in city politics but who is solid on the issues. A member of the Peace and Justice Commission and the KPFA board, she’s pushing alternative-fuel shuttles between the neighborhoods and is, like Sophie Hahn, a proponent of shop-local policies.

Berkeley School Board

Incumbent John Selawsky has, by almost every account and by almost any standard, done a great job on the school board. He’s mixed progressive politics with fiscal discipline and helped pull the district out of a financial mess a few years back. He knows how to work with administrators, teachers, and neighbors. He richly deserves another term.

Beatriz Levya-Cutler is a parent of a Berkeley High School student and has run a nonprofit that provides preschool care and supplemental education to Berkeley kids. She has the support of everyone from Tom Bates to Kriss Worthington. We’ll endorse her too.

The Berkeley left doesn’t always agree on everything, but there’s a pretty strong consensus in favor of this five-member slate for the Berkeley Rent Board. The five were nominated at an open convention, all have pledged to support tenant rights, and they will keep the board from losing it’s generally progressive slant.

Oakland City Council, at-large

REBECCA KAPLAN


Rebecca Kaplan, an AC Transit Board member, came in first in the June primary for this seat, well ahead of Kerry Hamill, but she fell short of 50 percent, so the two are in a runoff.

Hamill is the candidate of state Sen.(and East Bay kingmaker) Don Perata. Political committees with links to Perata have poured tens of thousands of dollars into a pro-Hamill campaign, and city council member Ignacio de la Fuente, a Perata ally, is raising money for Hamill too.

Kaplan is independent of the Perata political machine. She’s an energetic progressive with lots of good ideas — and a proven track record in office. While on the AC Transit Board, Kaplan pushed for free bus passes for low-income youths. When she decided she wanted the district to offer all-night transit service from San Francisco, she found a way to work with both her own board and the San Francisco Board of Supervisors to iron out the jurisdiction issues and get it done. Her platform calls for affordable housing, rational development, and effective community policing. She’s exactly the kind of candidate Oakland needs, and we’re happy to endorse her.

AC Transit Board of Directors

CHRIS PEEPLES


Chris Peeples was appointed to an open seat in 1997, elected in 1998, and reelected in 2000 and 2004. A longtime advocate for public transit, and AC Transit bus service in particular, Peeples is a widely respected board member who helped secure free transit for lower-income youths and the current low-cost youth passes. Involved in the AC Bus Riders Union, Alliance for AC Transit, Regional Alliance for Transit, Alliance for Sensible Transit, Coalition for a One-Stop Terminal, and many other transit groups, Peeples has served on the Oakland Ethics Commission and is active in the meetings of the Transportation Research Board and the American Public Transportation Association.

Peeples was also involved in the mess that was the Van Hool bus contract, in which AC Transit bought buses from a Belgian company that were poorly designed and had to be changed. Joyce Roy, who is well known in the East Bay for her lawsuit against the Oak to Ninth proposed development and her participation in the ensuing referendum effort, is challenging Peeples because of his support of the Van Hool buses. A retired architect and local public transit advocate, Roy lost the 2004 race for the AC Transit Board, Ward 2, post to current incumbent Greg Harper. But now she is running a stronger race because she has the support of the drivers and passengers, especially the seniors and the disabled, who find these buses uncomfortable and unsafe.

But given Peeples’s long history and generally good record, we’ll endorse him for another term.

GREG HARPER


An East Bay attorney and former Emeryville mayor, Greg Harper was elected in November 2000 and reelected in 2004 to represent Ward 2. Harper appears committed to ridership growth and has become increasingly critical of the district’s attempts to increase fares, not to mention the much maligned decision to purchase Van Hool buses. Harper is in favor of Bus Rapid Transit (BRT) and has a strong record of listening and being responsive to community concerns. He has said that if Berkeley votes to stop BRT-dedicated lanes, he’d only try to implement BRT in his district, if its makes sense.

DOUG LINNEY


With the East Bay falling short of targeted water savings, it’s increasingly vital that voters elect environmentally conscious EBMUD directors. Doug Linney fits the bill. First elected in 2002 and reelected in 2004, Linney is a solid progressive. This noncontroversial measure would give the city an additional year after the decennial census is completed to finish work on drawing new council districts. After the 2000 census, which undercounted urban populations, Berkeley (and other cities) had to fight to get the numbers adjusted, and that pushed the city up against a statutory limit for redistricting. Measure II would allow a bit more flexibility if, once again, the census numbers are hinky.

Berkeley law allows for only three medical marijuana clinics, and this wouldn’t change that limit. But Measure JJ would make pot clinics a defined and permitted use under local zoning laws. Since it’s hard — sometimes almost impossible — to find a site for a pot club now, this measure would allow existing clinics to stay in business if they have to move. Vote yes.

Repealing bus-only lanes

Yes, there are problems with the bus-only lanes in Berkeley (they don’t connect to the ferries, for example), but the idea is right. Measure KK would mandate voter approval of all new transit lanes; that’s crazy and would make it much harder for the city to create what most planners agree are essential new modes of public transit. Vote no.

Developers in Berkeley (and, sad to say, Mayor Tom Bates) see the Landmarks Preservation Commission as an obstacle to development, and they want to limit its powers. This is a referendum on the mayor’s new rules; if you vote no, you preserve the ability of the landmarks board to protect property from development.

This is a parcel tax to fund Oakland public schools. San Francisco just passed a similar measure, aimed at providing better pay for teachers. Parcel taxes aren’t the most progressive money source — people who own modest homes pay the same per parcel as the owners of posh commercial buildings — but given the lack of funding choices in California today, Measure N is a decent way to pay for better school programs. Vote yes.

This is a set-aside to fund children and youth services. We’re always wary about set-asides, but kids are a special case: children can’t vote, and services for young people are often tossed aside in the budget process. San Francisco’s version of this law has worked well. Vote yes.

Measure VV

AC Transit parcel tax

YES


In face of rising fuel costs and cuts in state funding, AC Transit wants to increase local funding to avoid fare increases and service cuts. Measure VV seeks to authorize an annual special parcel tax of $96 per year for 10 years, starting in 2009.

The money is intended for the operation and maintenance of the bus service. Two-thirds voter approval is needed. If passed, a community oversight committee would monitor how the money is being spent.

The measure has the support of the Sierra Club’s San Francisco Bay Chapter and the League of Women Voters.

Measure WW

Extension of existing East Bay Park District bond

YES


The East Bay Regional Park District operates 65 regional parks and more than a thousand miles of trails. It’s an amazing system and a wonderful resource for local residents. But the district needs ongoing sources of money to keep this system in good shape. Measure WW would reauthorize an existing East Bay Park District bond. This means that the owner of a $500,000 home would continue to pay $50 a year for the next 20 years.

One quarter of the monies raised would go to cities, special park and recreation districts, and county service areas. The remaining 75 percent would go toward park acquisitions and capital projects. The bonds constitute a moderate burden on property owners but seem like a small price to ensure access to open space for people of all economic backgrounds. Vote yes.

District 1

ERIC MAR


The incumbent District 1 supervisor, Jake McGoldrick, likes to joke that he holds his seat only because Eric Mar’s house burned down eight years ago. Back then Mar, who has had a stellar career on the school board, decided to wait before seeking higher office.

But now McGoldrick — overall a good supervisor who was wrong on a few key votes — is termed out, and progressive San Francisco is pretty much unanimous in supporting Mar as his successor.

Mar, a soft-spoken San Francisco State University teacher, was a strong critic of former school superintendent Arlene Ackerman and a leader in the battle to get the somewhat dictatorial and autocratic administrator out of the district. He’s been a key part of the progressive majority that’s made substantial progress in improving the San Francisco public schools.

He’s a perfect candidate for District 1. He has strong ties to the district and its heavily Asian population. He’s a sensible progressive with solid stands on the key issues and a proven ability to get things done. He supports the affordable housing measure, Proposition B; the Clean Energy Act, Proposition H; and the major new revenue measures. He’s sensitive to tenant issues, understands the need for a profound new approach to affordable housing, and wants to solve the city’s structural budget problems with new revenue, not just cuts.

His chief opponent, Sue Lee, who works for the Chamber of Commerce, doesn’t support Prop. H and won’t even commit to supporting district elections. She ducked a lot of our questions and was either intentionally vague or really has no idea what she would do as a supervisor. She’s no choice for the district, and we found no other credible candidates worthy of our endorsement. Vote for Eric Mar.

The danger in this district is Joe Alioto. He’s smooth, he’s slick, he’s well funded — and he would be a disaster for San Francisco. Make no mistake about it, Alioto is the candidate of downtown — and thanks to his famous name and wads of big-business cash, he’s a serious contender.

Two progressive candidates have a chance at winning this seat and keeping Alioto off the board. David Chiu is a member of the Small Business Commission (SBC) and the Democratic County Central Committee (DCCC) and is a former civil rights lawyer who now manages a company that sells campaign software. Denise McCarthy ran the Telegraph Hill Neighborhood Center for 25 years and spent 7 years on the Port Commission.

Tony Gantner, a retired lawyer, is also in the race, although he is running well behind the others in the polls.

We have concerns about all the candidates. Chiu has a solid progressive record as a commissioner and committee member: He was one of only two SBC members who supported the living-wage ordinance and Sup. Tom Ammiano’s city health care plan. He backed Sup. Aaron Peskin, his political mentor, for chair of the DCCC. He backs Prop. H, supports the two revenue measures and the affordable-housing fund, and wants to give local small businesses a leg up in winning city contracts. He has some creative ideas about housing, including a community stabilization fee on new development.

He’s also a partner in a company that received $143,000 last year from PG&E and that has worked with Republicans and some nasty business interests.

Chiu says he doesn’t get to call all the shots at Grassroots Enterprises, which he cofounded. He describes the firm as a software-licensing operation, which isn’t exactly true — the company’s own Web site brags about its ability to offer broad-based political consulting and communication services.

But Chiu vowed to resign from the company if elected, and given his strong record on progressive issues, we’re willing to take a chance on him.

McCarthy has a long history in the neighborhood, and we like her community perspective. She supports Prop. H and the affordable-housing measure. She’s a little weak on key issues like the city budget — she told us she "hadn’t been fully briefed," although the budget is a public document and the debate over closing a massive structural deficit ought to be a central part of any supervisorial campaign. And while she said there "have to be some new taxes," she was very vague on where new revenue would come from and what specifically she would be willing to cut. She supported Gavin Newsom for mayor in 2003 and told us she doesn’t think that was a bad decision. It was. But she has by far the strongest community ties of any candidate in District 3. She’s accessible (even listing her home phone number in her campaign material), and after her years on the Port Commission, she understands land-use issues.

Gantner has been a supporter of the Clean Energy Act from the start and showed up for the early organizing meetings. He has the support of the Sierra Club and San Francisco Tomorrow and talks a lot about neighborhood beatification. But we’re a little nervous about his law-and-order positions, particularly his desire to crack down on fairs and festivals and his strong insistence that club promoters are responsible for all the problems on the streets.

But in the end, Chiu, McCarthy, and Gantner are all acceptable candidates, and Joe Alioto is not. Fill your slate with these three.

District 4

DAVE FERGUSON


What a mess.

We acknowledge that this is one of the more conservative districts in the city. But the incumbent, Carmen Chu, and her main opponent, Ron Dudum, are terrible disappointments.

It’s possible to be a principled conservative in San Francisco and still win progressive respect. We often disagreed over the years with Quentin Kopp, the former supervisor, state senator, and judge, but we never doubted his independence, sincerity, or political skills. Sean Elsbernd, who represents District 7, is wrong on most of the key issues, but he presents intelligent arguments, is willing to listen, and isn’t simply a blind loyalist of the mayor.

Chu has none of those redeeming qualities. She ducks questions, waffles on issues, and shows that she’s willing to do whatever the powerful interests want. When PG&E needed a front person to carry the torch against the Clean Energy Act, Chu was all too willing: she gave the corrupt utility permission to use her name and face on campaign flyers, signed on to a statement written by PG&E’s political flak, and permanently disgraced herself. She says that most of the problems in the city budget should be addressed with cuts, particularly cuts in public health and public works, but she was unable to offer any specifics. She refused to support the measure increasing the transfer tax on property sales of more than $5 million, saying that she didn’t want to create "a disincentive to those sales taking place." We asked her if she had ever disagreed with Newsom, who appointed her, and she could point to only two examples: she opposed his efforts to limit cigarette sales in pharmacies, and she opposed Saturday road closures in Golden Gate Park. In other words, the only times she doesn’t march in lockstep with the mayor is when Newsom actually does something somewhat progressive. We can’t possibly endorse her.

Dudum, who ran a small business and tried for this office two years ago, continues to baffle us. He won’t take a position on anything. Actually, that’s not true — he’s opposed to the Clean Energy Act. Other than that, it’s impossible to figure out where he stands on anything or what he would do to address any of the city’s problems. (An example: When we asked him what to do about the illegal second units that have proliferated in the district, he said he’d solve the problem in two years. How? He couldn’t say.) We like Dudum’s small-business sentiments and his independence, but until he’s willing to take some stands and offer some solutions, we can’t support him.

Which leaves Dave Ferguson.

Ferguson is a public school teacher with little political experience. He’s a landlord, and not terribly good on tenant issues (he said he supported rent control when he was a renter, but now that he owns a four-unit building, he’s changed his mind). But he supports Prop. H, supports Prop. B, supports the revenue measures, and has a neighborhood sensibility. Ferguson is a long shot, but he’s the only candidate who made anything approaching a case for our endorsement.

District 5

ROSS MIRKARIMI


Mirkarimi won this seat four years ago after a heated race in a crowded field, and he’s quickly emerged as one of the city’s most promising progressive leaders. He understands that a district supervisor needs to take on tough citywide issues (he’s the lead author of the Clean Energy Act and won a surprisingly tough battle to ban plastic bags in big supermarkets) as well as dealing with neighborhood concerns. Mirkarimi helped soften a terrible plan for developing the old UC Extension site and fought hard to save John Swett School from closure.

But the area in which he’s most distinguished himself is preventing violent crime — something progressives have traditionally had trouble with. Four years ago, District 5 was plagued with terrible violence: murders took place with impunity, the police seemed unable to respond, and the African American community was both furious and terrified. Mirkarimi took the problem on with energy and creativity, demanding (and winning, despite mayoral vetoes) police foot patrols and community policing. Thanks to his leadership, violent crime is down significantly in the district — and the left in San Francisco has started to develop a progressive agenda for the crime problem.

He has no serious opposition, and richly deserves reelection.

District 7

SEAN ELSBERND


We rarely see eye to eye with the District 7 incumbent. He’s on the wrong side of most of the key votes on the board. He’s opposing the affordable housing measure, Prop. B. He’s opposed to the Clean Energy Act, Prop. H. It’s annoying to see someone who presents himself as a neighborhood supervisor siding with PG&E and downtown over and over again.

But Elsbernd is smart and consistent. He’s a fiscal conservative with enough integrity that he isn’t always a call-up vote for the mayor. He’s accessible to his constituents and willing to engage with people who disagree with him. The progressives on the board don’t like the way he votes — but they respect his intelligence and credibility.

Unlike many of the candidates this year, Elsbernd seems to understand the basic structural problem with the city budget, and he realizes that the deficit can’t be reduced just with spending cuts. He’s never going to be a progressive vote, but this conservative district could do worse.

District 9

The race to succeed Tom Ammiano, who served this district with distinction and is now headed for the State Legislature, is a case study in the advantages of district elections and ranked-choice voting. Three strong progressive candidates are running, and the Mission–Bernal Heights area would be well served by any of them. So far, the candidates have behaved well, mostly talking about their own strengths and not trashing their opponents.

The choice was tough for us — we like David Campos, Eric Quezada, and Mark Sanchez, and we’d be pleased to see any of them in City Hall. It’s the kind of problem we wish other districts faced: District 9 will almost certainly wind up with one of these three stellar candidates. All three are Latinos with a strong commitment to immigrant rights. All three have strong ties to the neighborhoods. Two are openly gay, and one is a parent. All three have endorsements from strong progressive political leaders and groups. All three have significant political and policy experience and have proven themselves accessible and accountable.

And since it’s almost inconceivable that any of the three will collect more than half of the first-place votes, the second-place and third-place tallies will be critical.

Campos, a member of the Police Commission and former school district general counsel, arrived in the United States as an undocumented immigrant at 14. He made it to Stanford University and Harvard Law School and has worked as a deputy city attorney (who helped the city sue PG&E) and as a school district lawyer. He’s been a progressive on the Police Commission, pushing for better citizen oversight and professional police practices. To his credit, he’s stood up to (and often infuriated) the Police Officers’ Association, which is often a foe of reform.

Campos doesn’t have extensive background in land-use issues, but he has good instincts. He told us he’s convinced that developers can be forced to provide as much as 50 percent affordable housing, and he thinks the Eastern Neighborhoods Plan lacks adequate low-cost units. He supports the revenue measures on the ballot and wants to see big business paying a fair share of the tax burden. He argues persuasively that crime has to become a progressive issue, and focuses on root causes rather than punitive programs. Campos has shown political courage in key votes — he supported Theresa Sparks for Police Commission president, a move that caused Louise Renne, the other contender, to storm out of the room in a fit of cursing. He backed Aaron Peskin for Democratic Party chair despite immense pressure to go with his personal friend Scott Weiner. Ammiano argues that Campos has the right qualities to serve on the board — particularly the ability to get six votes for legislation — and we agree.

Eric Quezada has spent his entire adult life fighting gentrification and displacement in the Mission. He’s worked at nonprofit affordable-housing providers, currently runs a homeless program, and was a cofounder of the Mission Anti-Displacement Coalition. Although he’s never held public office, he has far more experience with the pivotal issues of housing and land use than the other two progressive candidates.

Quezada has the support of Sup. Chris Daly (although he doesn’t have Daly’s temper; he’s a soft-spoken person more prone to civil discussion than fiery rhetoric). If elected, he would carry on Daly’s tradition of using his office not just for legislation but also as an organizing center for progressive movements. He’s not as experienced in budget issues and was a little vague about how to solve the city’s structural deficit, but he would also make an excellent supervisor.

Mark Sanchez, the only Green Party member of the three, is a grade-school teacher who has done a tremendous job as president of the San Francisco school board. He’s helped turn that panel from a fractious and often paralyzed political mess into a strong, functioning operation that just hired a top-notch new superintendent. He vows to continue as an education advocate on the Board of Supervisors.

He told us he thinks he can be effective by building coalitions; he already has a good working relationship with Newsom. He’s managed a $500 million budget and has good ideas on both the revenue and the spending side — he thinks too much money goes to programs like golf courses, the symphony, and the opera, whose clients can afford to cover more of the cost themselves. He wants a downtown congestion fee and would turn Market Street into a pedestrian mall. Like Campos, he would need some education on land-use issues (and we’re distressed that he supports Newsom’s Community Justice Center), but he has all the right political instincts. He has the strong support of Sup. Ross Mirkarimi. We would be pleased to see him on the Board of Supervisors.

We’ve ranked our choices in the order we think best reflects the needs of the district and the city. But we also recognize that the progressive community is split here (SEIU Local 1021 endorsed all three, with no ranking), and we have nothing bad to say about any of these three contenders. The important thing is that one of them win; vote for Campos, Quezada, and Sanchez — in that order, or in whatever order makes sense for you. Just vote for all three.

District 11

This is one of those swing districts where either a progressive or a moderate could win. The incumbent, Gerardo Sandoval, who had good moments and not-so-good moments but was generally in the progressive camp, is termed out and running for judge.

The strongest and best candidate to succeed him is John Avalos. There are two other credible contenders, Randy Knox and Julio Ramos — and one serious disaster, Ahsha Safai.

Avalos has a long history of public-interest work. He’s worked for Coleman Advocates for Children and Youth, for the Justice for Janitors campaign, and as an aide to Sup. Chris Daly. Since Daly has served on the Budget Committee, and at one point chaired it, Avalos has far more familiarity with the city budget than any of the other candidates. He understands that the city needs major structural reforms in how revenue is collected, and he’s full of new revenue ideas. Among other things, he suggests that the city work with San Mateo County to create a regional park district that could get state funds (and could turn McLaren Park into a destination spot).

He has a good perspective on crime (he supports community policing along with more police accountability) and wants to put resources into outreach for kids who are at risk for gang activity. He was the staff person who wrote Daly’s 2006 violence prevention plan. He wants to see more affordable housing and fewer luxury condos in the eastern neighborhoods and supports a congestion fee for downtown. With his experience both at City Hall and in community-based organizations, Avalos is the clear choice for this seat.

Randy Knox, a criminal defense lawyer and former member of the Board of Appeals, describes himself as "the other progressive candidate." He supports Prop. H and the affordable-housing fund. He links the crime problem to the fact that the police don’t have strong ties to the community, and wants to look for financial incentives to encourage cops to live in the city. He wants to roll back parking meter rates and reduce the cost of parking tickets in the neighborhoods, which is a populist stand — but that money goes to Muni, and he’s not sure how to replace it. He does support a downtown congestion fee.

Knox wasn’t exactly an anti-developer stalwart on the Board of Appeals, but we’ll endorse him in the second slot.

Julio Ramos has been one of the better members of a terrible community college board. He’s occasionally spoken up against corruption and has been mostly allied with the board’s progressive minority. He wants to build teacher and student housing on the reservoir adjacent to City College. He suggests that the city create mortgage assistance programs and help people who are facing foreclosure. He suggests raising the hotel tax to bring in more money. He supports public power and worked at the California Public Utilities Commission’s Division of Ratepayer Advocates, where he tangled with PG&E.

We’re backing three candidates in this district in part because it’s critical that Safai, the candidate of Mayor Newsom, downtown, and the landlords, doesn’t get elected. Safai (who refused to meet with our editorial board) is cynically using JROTC as a wedge against the progressives, even though the Board of Supervisors does not have, and will never have, a role in deciding the future of that program. He needs to be defeated, and the best way to do that is to vote for Avalos, Knox, and Ramos.

Two of the stalwart progressive leaders on the San Francisco School Board — Mark Sanchez and Eric Mar — are stepping down to run for supervisor. That’s a huge loss, since Mar and Sanchez were instrumental in getting rid of the autocratic Arlene Ackerman, replacing her with a strong new leader and ending years of acrimony on the board. The schools are improving dramatically — this year, for the first time in ages, enrollment in kindergarten actually went up. It’s important that the progressive policies Mar and Sanchez promoted continue.

Sandra Fewer is almost everyone’s first choice for the board. A parent who sent three kids to the San Francisco public schools, she’s done an almost unbelievable amount of volunteer work, serving as a PTA president for 12 terms. She currently works as education policy director at Coleman Advocates for Children and Youth. She knows the district, she knows the community, she’s full of energy and ideas, and she has the support of seven members of the Board of Supervisors and five of the seven current school board members.

Fewer supports the new superintendent and agrees that the public schools are getting better, but she’s not afraid to point out the problems and failures: She notes that other districts with less money are doing better. She wants to make the enrollment process more accessible to working parents and told us that race ought to be used as a factor in enrollment if that will help desegregate the schools and address the achievement gap. She’s against JROTC in the schools.

We’re a little concerned that Fewer talks about using district real estate as a revenue source — selling public property is always a bad idea. But she’s a great candidate and we’re happy to endorse her.

Norman Yee, the only incumbent we’re endorsing, has been something of a mediator and a calming influence on an often-contentious board. He helped push for the 2006 facilities bond and the parcel tax to improve teacher pay. He’s helped raise $1 million from foundations for prekindergarten programs. He suggests that the district take the radical (and probably necessary) step of suing the state to demand adequate funding for education. Although he was under considerable pressure to support JROTC, he stood with the progressives to end the military program. He deserves another term.

Barbara "Bobbi" Lopez got into the race late and has been playing catch-up. She’s missed some key endorsements and has problems with accessibility. But she impressed us with her energy and her work with low-income parents. A former legal support worker at La Raza Centro Legal, she’s now an organizer at the Tenderloin Housing Clinic, working with immigrant parents. She’s fought to get subsidized Muni fares for SFUSD students. Her focus is on parent involvement — and while everyone talks about bringing parents, particularly low-income and immigrant parents, more directly into the education process, Lopez has direct experience in the area.

Kimberly Wicoff has a Stanford MBA, and you can tell — she talks in a sort of business-speak with lots of reference to "outcomes." She has no kids. But she’s currently working with a nonprofit that helps low-income families in Visitacion Valley and Hunters Point, and we liked her clearheaded approach to the achievement gap. Wicoff is a fan of what she calls community schools; she thinks a "great school in every neighborhood" can go a long way to solving the lingering issues around the enrollment process. That’s a bit of an ambitious goal, and we’re concerned about any move toward neighborhood schools that leads to resegregation. But Wicoff, who has the support of both Mark Sanchez and Mayor Newsom, brings a fresh problem-solving approach that we found appealing. And unlike Newsom, she’s against JROTC.

Jill Wynns, who has been on the board since 1992, has had a distinguished career, and we will never forget her leadership in the battle against privatizing public schools. But she was a supporter of former superintendent Ackerman even when Ackerman was trampling on open-government laws and intimidating students, parents, and staff critics, and she supports JROTC. It’s time for some new blood.

Rachel Norton, a parent and an advocate for special-education kids, has run an appealing campaign, but her support for the save-JROTC ballot measure disqualified her for our endorsement.

As a footnote: H. Brown, a blogger who can be a bit politically unhinged, has no business on the school board and we’re not really sure why he’s running. But he offered an interesting idea that has some merit: he suggests that the city offer free Muni passes and free parking to anyone who will volunteer to mentor an at-risk SFUSD student. Why not?

Community College Board

There are four seats up for the seven-member panel that oversees the San Francisco Community College District, and we could only find three who merit endorsement. That’s a sad statement: City College is a local treasure, and it’s been badly run for years. The last chancellor, Phil Day, left under a cloud of corruption; under his administration, money was diverted from public coffers into a political campaign. The current board took bond money that the voters had earmarked for a performing arts center and shifted it to a gym — then found out that there wasn’t enough money in the operating budget to maintain the lavish facility. It’s a mess out there, and it needs to be cleaned up.

Fortunately, there are three strong candidates, and if they all win, the reformers will have a majority on the board.

Milton Marks is the only incumbent we’re supporting. He’s been one of the few board members willing to criticize the administration. He supports a sunshine policy for the district and believes the board needs to hold the chancellor accountable (that ought to be a basic principle of district governance, but at City College, it isn’t). He wants to push closer relations with the school board. He actually pays attention to the college budget and tries to make sure the money is spent the right way. He is pushing to reform the budget process to allow more openness and accountability.

Chris Jackson, a policy analyst at the San Francisco Labor Council, is full of energy and ideas. He wants to create an outreach center for City College at the public high schools. He also understands that the college district has done a terrible job working with neighborhoods and is calling for a comprehensive planning process. He understands the problems with the gym and the way the board shuffles money around, and he is committed to a more transparent budget process.

Jackson is also pushing to better use City College for workforce development, particularly in the biotech field, where a lot of the city’s new jobs will be created.

Jackson was president of the Associated Students at San Francisco State University, has been a member of the Youth Commission, and worked with Young Workers United on the city’s minimum-wage law. His experience, energy, and ideas make him an ideal candidate.

Bruce Wolfe attended City College after a workplace injury and served on the Associate Students Council. He knows both the good (City College has one of the best disability service programs in the state) and the bad (the school keeps issuing bonds to build facilities but doesn’t have the staff to keep them running). As a former member of the San Francisco Sunshine Ordinance Task Force, Wolfe is a strong advocate for open government, something desperately needed at the college district. He told us he thinks the college should agree to abide by the San Francisco Planning Code and is calling for a permanent inspector general to monitor administration practices and spending. He wants City College to start building housing for students. He has direct experience with the district and great ideas for improving it, and we’re happy to endorse him.

Incumbents Rodel Rodis and Natalie Berg are running for reelection; both have been a key part of the problem at City College, and we can’t endorse either of them. Steve Ngo, a civil rights lawyer, has the support of the Democratic Party, but we weren’t impressed by his candidacy. And he told us he opposes the Clean Energy Act.

Vote for Marks, Jackson, and Wolfe.

BART Board of Directors

With rising gasoline prices, congested roadways, and global warming, it’s now more important than ever to have an engaged and knowledgeable BART board that is willing to reform a system that effectively has San Francisco users subsidizing everyone else. That means developing a fare structure in which short trips within San Francisco or the East Bay urban centers are cheaper and longer trips are a bit more expensive. BART should also do away with free parking, which favors suburban drivers (who tend to be wealthier) over urban cyclists and pedestrians. San Francisco’s aging stations should then get the accessibility and amenity improvements they need—and at some point the board can even fund the late-night service that is long overdue. There are two candidates most capable of meeting these challenges:

District 7

LYNETTE SWEET


This district straddles San Francisco and the East Bay, and it’s crucial that San Francisco—which controls just three of the nine seats—retain its representative here. We would like to see Lynette Sweet more forcefully represent the interests of riders from San Francisco and support needed reforms such as civilian oversight of BART police. But she has a strong history of public service in San Francisco (having served on San Francisco’s taxi and redevelopment commissions before joining the BART board in 2003), and we’ll endorse her.

District 9

TOM RADULOVICH


Tom Radulovich is someone we’d love to clone and have run for every seat on the BART board, and perhaps every other transportation agency in the Bay Area. He’s smart and progressive, and he works hard to understand the complex problems facing our regional transportation system and then to develop and advocate for creative solutions. As executive director of the nonprofit Livable City, Radulovich is a leader of San Francisco’s alternative transportation brain trust, widely respected for walking the walk (and biking the bike—he doesn’t own a car) and setting an example for how to live and grow in the sustainable way this city and country needs.

Election as prologue

San Francisco politics shifted June 3 as successful new coalitions altered the electoral landscape heading into the high-stakes fall contests, when seven of the 11 seats on the Board of Supervisors are up for grabs.
Progressives had a good election night even as lefty shot-caller Sup. Chris Daly suffered a pair of bitter defeats. And Mayor Gavin Newsom scored a rare ballot box victory when the southeast development measure Proposition G passed by a wide margin, although voters repudiated Newsom’s meddling with the San Francisco Public Utilities Commission by approving Prop. E.

But the big story wasn’t these two lame duck politicians, who have served as the two poles of local politics for the past few years. It was Mark Leno, who handed Sen. Carole Migden her first electoral defeat in 25 years by bringing together progressives and moderates and waging an engaged, effective ground campaign. In the process, he may have offered a portent of things to come.

The election night speech Leno gave just before midnight — much like his entire campaign — didn’t break along neat ideological lines. There were solidly progressive stands, like battling the religious right’s homophobia, pledging to pursue single-payer health care, and blasting Pacific Gas & Electric Co. for funding sleazy attack pieces against him, reaffirming his commitment to public power.

But he also thanked Newsom and other moderate supporters and heaped praise on his political consulting firm, BMWL, which has run some of downtown’s nastiest campaigns. "It was clean, it was smart, and it was effective," Leno said of his campaign.

The Migden campaign, which had the support of Daly and many prominent local progressives, often looked dirty by comparison, marred by past campaign finance violations that resulted in Migden getting slapped with the biggest fine in state history and by Daly’s unethical misuse of the Guardian logo on a mailer that made it appear as if we had endorsed Migden.

Old alliances seemed to crumble around this election, leaving open questions about how coalitions will form going into an important November election that’s expected to have a crowded ballot and huge turnout.

UNITY AND DIVISION


There are things that unite almost all San Franciscans, like support for public schools. In this election that support came in the form of Prop. A — a measure that will increase teacher salaries through a parcel tax of about $200 per property owner — which garnered almost 70 percent of the vote.

"These numbers show that people believe in public education. They believe in what we’re doing," school superintendent Carlos Garcia told a jubilant election night crowd inside the Great American Music Hall.

Also uniting the city’s Democrats was the news that Barack Obama sewed up the party’s presidential nomination June 3, ending a primary battle with Hillary Clinton that had created a political fissure here and in cities across the country.

"The winds of change are blowing tonight. Let me congratulate Barack Obama on his victory," Leno said on election night, triggering a chant of "Yes we can" from the crowd at the Upper Market bar/restaurant Lime.

Local Clinton supporters were already switching candidates on election night, even before Clinton dropped her campaign and announced her support for Obama four days later.

"As a strong Hillary person, I’m so excited to be working for Obama these next five months," DCCC District 13 member Laura Spanjian, who won reelection by placing fourth out of 12 slots, said on election night. "It’s my number one goal this fall."

Leno also sounded conciliatory themes. In his election night speech, Leno acknowledged the rift he created in the progressive and LGBT communities by challenging Migden: "I know that you upset the applecart when you challenge a sitting senator."

But he vowed to repair that damage, starting by leading the fight against the fall ballot measure that would ban same-sex marriage and overturn the recent California Supreme Court decision that legalized it. He told the crowd, "I invite you to join together to defeat the religious right."

A day later we asked Leno about whether his victory represented a new political center in San Francisco and he professed a desire to avoid the old political divisions: "Let’s focus on our commonalities rather than differences," he said, "because there is real strength in a big-tent coalition."

But this election was more about divisions than unity, splits whose repercussions will ripple into November in unknown ways. Shortly before the election, Daly publicly blasted "Big Labor" after the San Francisco Labor Council cut a deal with Lennar Corporation, agreeing to support Prop. G in exchange for the promise of more affordable housing and community benefits.

On election night, Newsom couldn’t resist gloating over besting Daly, whose affordable housing measure Prop. F lost big. "I couldn’t be more proud that the voters of San Francisco supported a principled proposal over the political proposal of a politician," Newsom told us on election night, adding, "Today was a validation of community investment and involvement over political games."

While Daly and some of his progressive allies have long warned that Leno is too close to Newsom to be trusted, one of the first points in Leno’s speech was the celebrate the passage of Prop. E, which gives the Board of Supervisors more power to reject the mayor’s appointees to the San Francisco Public Utilities Commission. "As an early supporter I was happy to see that," Leno said.

Susan Leal, the former SFPUC director who was ousted by Newsom earlier this year, said she felt some vindication from the vote on Prop. E, but mostly she was happy that people saw through the false campaign portrayals (which demonized the Board of Supervisors and erroneously said the measure gave it control over the SFPUC.)

"This is one of the few PUCs where people are appointed and doing the mayor’s bidding is the only qualification," Leal told us on election night.
Sup. Tom Ammiano, who will be headed to the Assembly next year, agreed: "It shows the beauty contest with the mayor is over and people are willing to hold him accountable."

ANALYZING THE RESULTS


On the day after the election, during a postmortem at the downtown office of the San Francisco Planning and Urban Research Association, political consultants Jim Stearns and David Latterman sized up the results.

Latterman called the Prop. E victory "the one surprise in the race." The No on E campaign sought to demonize the Board of Supervisors, a strategy that clearly didn’t work. Firing Leal, a lesbian, helped spur the city’s two major LGBT groups — the Harvey Milk and Alice B. Toklas Democratic clubs — to endorse the measure, which could have been a factor when combined with the high LGBT turnout.

"This may have ridden the coattails of the Leno-Migden race," Stearns said.

In that race, Stearns and Latterman agreed that Leno ran a good campaign and Migden didn’t, something that was as big a factor in the outcome as anything.
"Migden did too little too late. The numbers speak for themselves. Leno ran a really good race," Latterman said, noting how Leno beat Migden by a large margin in San Francisco and came within a few thousand votes of beating Joe Nation on his home turf of Marin County.

"It was a big deal for Leno to get so close to Nation in Marin," Stearns said.

Leno told us the polling his campaign did late last year and early this year showed he had a strong advantage in San Francisco, "so with that, I invested a lot of time and energy in Marin County."

Stearns attributed the big Prop. G win to its large base of influential supporters: "The coalition-building was what put this over the top." Daly chalked it up to the $4 million that Lennar spent, saying it had bought the election. But Stearns, who was a consultant for the campaign, didn’t agree: "I don’t think money alone ever wins or loses campaigns."

Yet he said the lack of money and an organized No on G/Yes on F campaign did make it difficult to stop the Lennar juggernaut. "You need to have enough money to get your message out," Stearns said, noting that "Nobody knew that the Sierra Club opposed [Prop. G]."

In the one contested judge’s race on the ballot, Gerardo Sandoval finished in a virtual dead heat with incumbent Judge Thomas Mellon. The two will face off again in a November runoff election because a third candidate, Mary Mallen, captured about 13 percent of the vote.

"How angry is Sandoval with Mallen now?" Latterman asked at the SPUR event. "If that 13 percent wasn’t there, Sandoval wins."

Both Latterman and Stearns agreed that this election was Sandoval’s best shot at unseating a sitting judge. "He’s going to face a tougher test in November," Stearns said.

The other big news was the lopsided defeat of Prop. 98, which would have abolished rent control and limits on condo conversions in addition to its main stated aim of restricting the use of eminent domain by local governments.

"It just lost bad," Latterman said of Prop. 98, the second extreme property rights measure to go down in recent years. "It just needs to go away now…. This was a resounding, ‘Just go away now, please.’<0x2009>"

LOOKING FORWARD


Aside from the Leno victory, this election was most significant in setting up future political battles. And progressives won a big advantage for the battles to come by picking up seats on the city’s two Democratic County Central Committees, a successful offensive engineered largely by Daly and Peskin, who were both elected to the eastside DCCC District 13.

"On the DCCC level, we took back the Democratic Party," said Robert Haaland, a progressive who was reelected to the DCCC District 13.

"The fight now is over the chair. The chair decides where the resources go and sets the priorities, so you can really do a lot," Haaland told us.

Many of the fall supervisorial contests feature races between two or three bona fide progressives, so those candidates are going to need to find issues or alliances that will broaden their bases.

In District 9, for example, the candidates include housing activist Eric Quezada (who lost his DCCC race), school board president Mark Sanchez, and Police Commission member David Campos — all solid progressives, all Latino, and all with good bases of support.

Campos finished first in his DCCC District 13 race just ahead of Peskin. Speaking on election night at the GAMH, Campos attributed his strong showing to walking lots of precincts and meeting voters, particularly in the Mission, an effort that will help him in the fall.

"A lot of Latino voters are really eager to be more involved [in politics]," Campos said. "Speaking the language and being an immigrant really connects with them."

Campos thinks public safety will be a big issue on voters’ minds this fall, an issue where he has strength and one that progressives have finally seized. "Until Ross Mirkarimi came along, progressives really weren’t talking about it," Campos said.

So, does Campos’ strong DCCC showing make him the front runner? When I asked that question during the SPUR event, Latterman said he didn’t think so. He noted that Sanchez has always had strong finishes on his school board races, citywide contests that includes the Portola area in District 9 but not in DCCC District 13. In fact, Latterman predicted lots of acrimony and close contests this November.

"If you like the anger of Leno vs. Migden, we’ll have more in the fall," Latterman said of the competitive supervisorial races.

Leno hasn’t been terribly active in local contests since heading to Sacramento, and he told us that his focus this fall will be on state ballot fights and the presidential race. He hasn’t made endorsements in many supervisorial races yet, but his two so far are both of progressives: Ross Mirkarimi in District 5, and David Chiu in District 3. And as he makes more supervisorial endorsements in the coming months, Leno told us, "I will be fighting for progressive voices."

More than just Mirkarimi’s kickoff

Supervisor Ross Mirkarimi kicks off his campaign for reelection this evening at Yoshi’s Jazz Club in the heart of the Fillmore. The Board of Supervisors’ only Green Party member is popular in his District 5 — made up of the super lefty Haight and crime-plagued Western Addition, where Mirkarimi has shown real leadership in pushing police foot patrols and other reforms — and is expected to cruise to a relatively easy victory.

But today’s event carries a far larger symbolic significance: it is the beginning of a long campaign to create a progressive narrative for San Francisco that counters the centrist and fairly superficial approach of Mayor Gavin Newsom. And that’s a struggle that will carry through this fall’s high-stakes supervisorial elections, into the vote for a new board president in January, and on into the next mayor’s race — all of which could feature Mirkarimi in a starring role.

Wait, wasn’t the primary election back in February? Yes, it was — in a way. The California Legislature, in an effort to make the state more relevant (that turned out well, didn’t it?) moved the presidential primary several months earlier this year but left the rest of the primary races, and some key initiatives, for the June 3 ballot. There’s a lot at stake here: three contested Legislative races, two judicial races, a measure that could end rent control in California … vote early and often. Our endorsements follow.

National races

Congress, District 6

LYNN WOOLSEY


It’s an irony that the congressional representative from Marin and Sonoma counties is far to the left of the representative from San Francisco, but Lynn Woolsey’s politics put Nancy Pelosi to shame. Woolsey was against the Iraq war from the start and the first member of Congress to demand that the troops come home, and she continues to speak out on the issue. At the same time, she’s also a strong advocate for injured veterans.

Woolsey, who once upon a time (many years ago) was on welfare herself, hasn’t forgotten what it’s like to have trouble making ends meet. She’s a leading voice against cuts in social service spending and is now pushing a bill to increase food stamp benefits. She richly deserves reelection.

Congress, District 7

GEORGE MILLER


George Miller, who has represented this East Bay district since 1974, is an effective legislator and strong environmentalist. Sometimes he’s too willing to compromise — he worked with the George W. Bush administration on No Child Left Behind, a disaster of an education bill — but he’s a solid opponent of the war and we’ll endorse him for another term.

Congress, District 8

NO ENDORSEMENT


Cindy Sheehan, the antiwar activist, is moving forward with her campaign to challenge Nancy Pelosi as an independent candidate in November, and we wish her luck. For now, Pelosi, the Speaker of the House and one of the most powerful people in Washington, will easily win the Democratic primary.

But Pelosi long ago stopped representing her San Francisco district. She continues to support full funding for Bush’s war, refused to even consider impeachment (back when it might have made sense), refused to interact with war critics who camped out in front of her house … and still won’t acknowledge it was a mistake to privatize the Presidio. We can’t endorse her.

Congress, District 13

PETE STARK


You have to love Pete Stark. The older he gets, the more radical he sounds — and after 32 years representing this East Bay district, he shows no signs of slowing down. Stark is unwilling to be polite or accommodating about the Iraq war. In 2007 he announced on the floor of the House that the Republicans "don’t have money to fund the war or children. But you’re going to spend it to blow up innocent people if we can get enough kids to grow old enough for you to send to Iraq to get their heads blown off for the president’s amusement." He happily signed on to a measure to impeach Vice President Dick Cheney. He is the only member of Congress who proudly admits being an atheist. It’s hard to imagine how someone like Stark could get elected today. But we’re glad he’s around.

Nonpartisan offices

Superior Court, Seat 12

GERARDO SANDOVAL


There aren’t many former public defenders on the bench in California. For years, governors — both Democratic and Republican — have leaned toward prosecutors and civil lawyers from big downtown firms when they’ve made judicial appointments. So the San Francisco judiciary isn’t, generally speaking, as progressive or diverse as the city.

Sup. Gerardo Sandoval, who will be termed out this year, is looking to become a judge — and there’s no way this governor would ever appoint him. So he’s doing something that’s fairly rare, even in this town: he’s running for election against an incumbent.

We’re happy to see that. It’s heartening to see an actual judicial election. Judges are technically elected officials, but most incumbents retire in the middle of their terms, allowing the governor to appoint their replacements, and unless someone files to run against a sitting judge, his or her name doesn’t even appear on the ballot.

Sandoval is challenging Judge Thomas Mellon, a Republican who was appointed by Gov. Pete Wilson in 1994. He’s not known as a star on the bench: according to California Courts and Judges, a legal journal that profiles judges and includes interviews with lawyers who have appeared before them, Mellon has a reputation for being unreasonable and cantankerous. In 2000, the San Francisco Public Defenders Office sought to have him removed from all criminal cases because of what the defense lawyers saw as a bias against them and their clients.

Sandoval hasn’t been a perfect supervisor, and we’ve disagreed with him on a number of key issues. But he’s promised us to work for more openness in the courts (including open meetings on court administration), and we’ll give him our endorsement.

State races and propositions

State Senate, District 3

MARK LENO


It doesn’t get any tougher than this — two strong candidates, each with tremendous appeal and a few serious weaknesses. Two San Francisco progressives with distinguished records fighting for a powerful seat that could possibly be lost to a third candidate, a moderate from Marin County who would be terrible in the job. Two people we genuinely like, for very different reasons. It’s fair to say that this is one of the hardest decisions we’ve had to make in the 42-year history of the Guardian.

In the end, we’ve decided — with much enthusiasm and some reservations — to endorse Assemblymember Mark Leno.

We will start with the obvious: this race is the result of term limits. Leno, who has served in the state Assembly for six years, argues, convincingly, that he is challenging incumbent state Sen. Carole Migden because he feels she hasn’t been doing the job. But Leno also loves politics, has no desire to return to life outside the spotlight, and if he could have stayed in the Assembly, the odds that he would have taken on this ugly and difficult race are slim. And if Leno hadn’t opened the door and exposed Migden’s vulnerability, there’s no way former Assemblymember Joe Nation of Marin would have thrown his hat into the ring. We’ve always opposed term limits; we still do.

That said, we’ll hold a few truths to be self-evident: In a one-party town, the only way any incumbent is ever held accountable is through a primary challenge. Those challenges can be unpleasant, and some — including Migden and many of her allies — argue that they’re a waste of precious resources. If Migden wasn’t scrambling to hold onto her seat, she’d be spending her money and political capital trying to elect more Democrats to the state Legislature. But Leno had every right to take on Migden. And win or lose, he has done a laudable public service: it’s been years since we’ve seen Migden around town, talking to constituents, returning phone calls and pushing local issues the way she has in the past few months. And while there will be some anger and bitterness when this is over — and some friends and political allies have been at each other’s throats and will have to figure out how to put that behind them — on balance this has been good for San Francisco. Migden has done much good, much to be proud of, but she had also become somewhat imperious and arrogant, a politician who hadn’t faced a serious election in more than a decade. If this election serves as a reminder to every powerful Democratic legislator that no seat is truly safe (are you listening, Nancy Pelosi?), then the result of what now seems like a political bloodbath can be only positive.

The Third Senate District, a large geographic area that stretches from San Francisco north into Sonoma County, needs an effective, progressive legislator who can promote issues and programs in a body that is not known as a bastion of liberal thought.

Both Migden and Leno can make a strong case on that front. Leno, for example, managed to get passed and signed into law a bill that amends the notorious pro-landlord Ellis Act to protect seniors and disabled people from evictions. He got both houses of the Legislature to approve a marriage-equality bill — twice. During his tenure in the unpleasant job of chairing the Public Safety Committee, he managed to kill a long list of horrible right-wing bills and was one of the few legislators to take a stand against the foolish measure that barred registered sex offenders from living near a park or school. Migden helped pass the landmark community-aggregation bill that allows cities to take a big step toward public power. She’s also passed several key bills to regulate or ban toxic substances in consumer products.

Migden’s record isn’t all positive, though. For a time, she was the chair of the powerful Appropriations Committee — although she gave up that post in 2006, abandoning a job that was important to her district and constituents, to devote more time to campaigning for Steve Westly, a moderate candidate for governor. When we challenged her on that move, she showed her legendary temper, attacking at least one Guardian editor personally and refusing to address the issue at hand. Unfortunately, that isn’t unusual behavior.

Then there’s the matter of ethics and campaign finance laws. The Fair Political Practices Commission has fined Migden $350,000 — the largest penalty ever assessed against a state lawmaker — for 89 violations of campaign finance laws. We take that seriously; the Guardian has always strongly supported ethics and campaign-finance laws, and this level of disregard for the rules raises serious doubts for us about Migden’s credibility.

Sup. Chris Daly posted an open letter to us on his blog last week, and he made a strong pitch for Migden: "While there are only a few differences between Carole and Mark Leno on the issues," he wrote, "when it comes to San Francisco politics, the two are in warring political factions. Carole has used her position in Sacramento consistently to help progressive candidates and causes in San Francisco, while Leno is a kinder, gentler Gavin Newsom."

He’s absolutely right. On the local issues we care about, Migden has been with us far more than Leno. When the public power movement needed money and support in 2002, Migden was there for us. When the University of California and a private developer were trying to turn the old UC Extension campus into luxury housing, Migden was the one who helped Sup. Ross Mirkarimi demand more affordable units. Migden was the one who helped prevent a bad development plan on the Port. Migden stood with the progressives in denouncing Newsom’s budget — and Leno stood with the mayor.

The district supervisorial battles this fall will be crucial to the city’s future, and Migden has already endorsed Eric Mar, the best progressive candidate for District 1, and will almost certainly be with John Avalos, the leading progressive in District 11. Leno may well back a Newsom moderate. In fact, he’s made himself a part of what labor activist Robert Haaland aptly calls the "squishy center" in San Francisco, the realm of the weak, the fearful, and the downtown sycophants who refuse to promote progressive taxes, regulations, and budgets at City Hall. His allegiance to Newsom is truly disturbing.

There’s a war for the soul of San Francisco today, as there has been for many years, and Leno has often tried to straddle the battle lines, sometimes leaning a bit to the wrong camp — and never showing the courage to fight at home for the issues he talks about in Sacramento. We’ll stipulate to that — and the only reason we can put it aside for the purposes of this endorsement is that Leno has never really had much in the way of coattails. He supports the wrong candidates, but he doesn’t do much for them — and we sincerely hope it stays that way.

While Leno is too close to Newsom, we will note that Migden is far too close to Gap founder and Republican leader Don Fisher, one of the most evil players in local politics. She proudly pushed to put Fisher — who supports privatizing public schools — on the state Board of Education.

A prominent local progressive, who we won’t identify by name, called us several months ago to ask how were going to come down in this race, and when we confessed indecision, he said: "You know, I really want to support Carole. But she makes it so hard."

We find ourselves in a similar position. We really wanted to support Migden in this race. We’d prefer to see the state senator from San Francisco using her fundraising ability and influence to promote the candidates and causes we care about.

But Migden has serious political problems right now, baggage we can’t ignore — and it’s all of her own making. Migden says her problems with the Fair Political Practices Commission are little more than technical mistakes — but that’s nonsense. She’s played fast and loose with campaign money for years. When it comes to campaign finance laws, Migden has always acted as if she rules don’t apply to her. She’s treated FPPC fines as little more than a cost of doing business. This latest scandal isn’t an exception; it’s the rule.

Unfortunately, it’s left her in a position where she’s going to have a hard time winning. Today, the election looks like a two-person race between Leno and Nation. And the threat of Joe Nation winning this primary is too great for us to mess around.

Despite our criticism of both candidates, we would be happy with either in the state Senate. We’re taking a chance with Leno; he’s shown some movement toward the progressive camp, and he needs to continue that. If he wins, he will have a huge job to do bringing a fractured queer and progressive community back together — and the way to do that is not by simply going along with everything Newsom wants. Leno has to show some of the same courage at home he’s shown in Sacramento.

But right now, today, we’ve endorsing Mark Leno for state Senate.

State Senate, District 9

LONI HANCOCK


This is another of several tough calls, another creature of term limits that pit two accomplished and experienced termed-out progressive assembly members against each other for the senate seat of termed-out Don Perata. We’ve supported both Loni Hancock and Wilma Chan in the past, and we like both of them. In this one, on balance, we’re going with Hancock.

Hancock has a lifetime of experience in progressive politics. She was elected to the Berkeley City Council in 1971, served two terms as Berkeley mayor, worked as the US Department of Education’s western regional director under Bill Clinton, and has been in the State Assembly the past six years. On just about every progressive issue in the state, she’s been an activist and a leader. And at a time when the state is facing a devastating, crippling budget crisis that makes every other issue seem unimportant, Hancock seems to have a clear grasp of the problem and how to address it. She’s thought through the budget calculus and offers a range of new revenue measures and a program to change the rules for budget passage (two-thirds vote in the legislature is needed to pass any budget bill, which gives Republicans, all but one who has taken a Grover Norquist–inspired pledge never to raise taxes, an effective veto).

Chan, who represented Oakland in the assembly for six years, is a fighter: she’s taken on the insurance industry (by cosponsoring a major single-payer health insurance bill), the chemical industry (by pushing to ban toxic materials in furniture, toys, and plumbing fixtures), and the alcoholic-beverages lobby (by seeking taxes to pay for treatment for young alcoholics). She’s an advocate of sunshine, not just in government, where she’s calling for an earlier and more open budget process, but also in the private sector: a Chan bill sought to force health insurance companies to make public the figures on how often they decline claims.

But she seems to us to have less of a grasp of the budget crisis and the level of political organizing it will take to solve it. Right now, at a time of financial crisis, we’re going with Hancock’s experience and broader vision.

State Assembly, District 12

FIONA MA


We were dubious about Ma. She was a pretty bad supervisor, and when she first ran for Assembly two years ago, we endorsed her opponent. But Ma’s done some good things in Sacramento — she’s become one of the leading supporters of high-speed rail, and she’s working against state Sen. Leland Yee’s attempt to give away 60 acres of public land around the Cow Palace to a private developer. She has no primary opponent, and we’ll endorse her for another term.

State Assembly, District 13

TOM AMMIANO


This one’s easy. Ammiano, who has been a progressive stalwart on the Board of Supervisors for more than 15 years, is running with no opposition in the Democratic primary for state Assembly, and we’re proud to endorse his bid.

Although he’s certain to win, it’s worth taking a moment to recall the extent of Ammiano’s service to San Francisco and the progressive movement. He authored the city’s domestic partners law. He authored the living wage law. He created the universal health care program that Mayor Newsom is trying to take credit for. He sponsored the 2002 public-power measure that would have won if the election hadn’t been stolen. He created the Children’s Fund. He authored the Rainy Day Fund law that is now saving the public schools in San Francisco. And the list goes on and on.

Beyond his legislative accomplishments, Ammiano has been a leader — at times, the leader — of the city’s progressive movement and is at least in part responsible for the progressive majority now on the Board of Supervisors. In the bleak days before district elections, he was often the only supervisor who would carry progressive bills. His 1999 mayoral challenge to incumbent Willie Brown marked a tectonic shift in local politics, galvanizing the left and leading the way to the district-election victories that brought Aaron Peskin, Matt Gonzalez, Jake McGoldrick, Chris Daly, and Gerardo Sandoval to office in 2000.

It’s hard to imagine the San Francisco left without him.

Ammiano will do a fine job in Sacramento, and will continue to use his influence to push the progressive agenda back home.

State Assembly, District 14

KRISS WORTHINGTON


This is another tough one. The race to replace Loni Hancock, one of the most progressive and effective legislators in the state, has drawn two solid, experienced, and well-qualified candidates: Berkeley City Council member Kriss Worthington and former council member Nancy Skinner. We like Skinner, and she would make an excellent assemblymember. But all things considered, we’re going with Worthington.

Skinner was on the Berkeley council from 1984 to 1992 and was part of a progressive majority in the 1980s that redefined how the left could run a city. That council promoted some of the best tenant protection and rent control laws in history, created some of the best local environmental initiatives, and fought to build affordable housing and fund human services. Skinner was responsible for the first local law in the United States to ban Styrofoam containers — a measure that caused McDonald’s to change its food-packaging policies nationwide. She went on to found a nonprofit that helps cities establish sustainable environmental policies.

Skinner told us that California has "gutted our commitment to education," and she vowed to look for creative new ways to raise revenue to pay for better schools. She’s in touch with the best economic thinkers in Sacramento, has the endorsement of Hancock (and much of the rest of the East Bay Democratic Party establishment), and would hit the ground running in the legislature.

Worthington, Berkeley’s only openly gay council member, has been the voice and conscience of the city’s progressive community for the past decade. He’s also been one of the hardest-working politicians in the city — a recent study by a group of UC Berkeley students found that he had written more city council measures than anyone else currently on the council and had won approval for 98 percent of them.

Worthington has been the driving force for a more effective sunshine law in Berkeley, and has been unafraid to challenge the liberal mayor, Tom Bates, and other leading Democrats. His campaign slogan — "a Democrat with a backbone" — has infuriated some of the party hierarchy with its clear (and intended) implication that a lot of other Democrats lack a spine.

"All of the Democrats in the assembly voted for 50,000 more prison beds," he told us. "We needed a Barbara Lee [who cast Congress’ lone vote against George W. Bush’s first war resolution] to stand up and say, ‘this is wrong and I won’t go along.’"

That’s one of the things we like best about Worthington: on just about every issue and front, he’s willing to push the envelope and demand that other Democrats, even other progressive Democrats, stand up and be counted. Which is exactly what we expect from someone who represents one of the most progressive districts in the state.

It’s a close call, but on this one, we’re supporting Kriss Worthington.

There’s a little rhyme to help you remember which way to vote on this critical pair of ballot measures:

"We hate 98, but 99 is fine."

The issue here is eminent domain, which is making its perennial ballot appearance. Californians don’t like the idea of the government seizing their property and handing it over to private developers, and the most conservative right-wing forces in the state are trying to take advantage of that.

Think about this: if Prop. 98 passes, there will be no more rent control in California. That means thousands of San Francisco tenants will lose their homes. Many could become homeless. Others will have to leave town. All the unlawful-evictions laws will be tossed out. So will virtually any land-use regulations, which is why all the environmental groups also oppose Prop. 98.

In fact, everyone except the Howard Jarvis anti-tax group hates this measure, including seniors, farmers, water districts, unions, and — believe it or not — the California Chamber of Commerce.

Prop. 99, on the other hand, is an unapologetic poison-pill measure that’s been put on the ballot for two reasons: to fix the eminent domain law once and for all, and kill Prop. 98 if it passes. It’s simply worded and goes to the heart of the problem by preventing government agencies from seizing residential property to turn over to private developers. If it passes, the state will finally get beyond the bad guys using the cloak of eminent domain to destroy all the provisions protecting people and the environment.

If anyone has any doubts about the motivation here, take a look at the money: the $3 million to support Prop. 98 came almost entirely from landlords.

This is the single most important issue on the ballot. Remember: no on 98, yes on 99.

San Francisco measures

Proposition A

School parcel tax

YES, YES, YES


Every year, hundreds of excellent teachers leave the San Francisco Unified School District. Some retire after a career in the classroom, but too many others — young teachers with three to five years of experience — bail because they decide they can’t make enough money. San Francisco pays less than public school districts in San Mateo and Marin counties and far less than private and charter schools. And given the high cost of living in the city, a lot of qualified people never even consider teaching as a profession. That harms the public school system and the 58,000 students who rely on it.

It’s a statewide problem, even a national one — but San Francisco, with a remarkable civic unity, is moving to do something about it. Proposition A would place an annual tax on every parcel of land in the city; the typical homeowner would pay less than $200 a year. The money would go directly to increasing pay — mostly starting pay — for teachers. The proposition, which has the support of almost everyone in town except the Republican Party, is properly targeted toward the newer teachers, with the goal of keeping the best teachers on the job past that critical three to five years.

Parcel taxes aren’t perfect; they force homeowners and small businesses to pay the same rate as huge commercial property owners. The way land is divided in the city most big downtown properties sit on at least five, and sometimes as many as 10 or 20 parcels, so the bill will be larger for them. But it’s still nowhere near proportionate.

Still, Prop. 13 has made it almost impossible to raise ad valorum property taxes (based on a property’s assessed value) in the state, and communities all around the Bay are using parcel taxes as a reasonable if imperfect substitute.

There’s a strong campaign for Prop. A and not much in the way of organized opposition, but the measure still needs a two-thirds vote. So for the sake of public education in San Francisco, it’s critical to vote yes.

Proposition B

City retiree benefits change

YES


San Francisco has always offered generous health and retirement benefits to its employees. That’s a good thing. But in this unfortunate era, when federal money is getting sucked into Iraq, state money is going down the giant deficit rat hole, and nobody is willing to raise taxes, the bill for San Francisco’s expensive employee benefit programs is now looking to create a fiscal crisis at City Hall. Officials estimate the payout for current and past employees could total $4 billion over the next 30 years.

So Sup. Sean Elsbernd and his colleagues on the Board of Supervisors have engineered this smart compromise measure in a way that saves the city money over the long run and has the support of labor unions (largely because it includes an increase in the pensions for longtime employees, partially offset by a one-year wage freeze starting in 2009) while still offering reasonable retirements benefits for new employees.

Previously, city employees who worked just five years could get taxpayer-paid health benefits for life. Under this measure, it will take 20 years to get fully paid health benefits, with partially paid benefits after 10 years.

It’s rare to find an issue that has the support of virtually everyone, from the supervisors and the mayor to labor. Prop. B makes sense. Vote yes.

Proposition C

Benefit denials for convicts

NO


On the surface, it’s hard to argue against Prop. C, a measure promoted as a way to keep crooks from collecting city retirement benefits. Sup. Sean Elsbernd’s ballot measure would update an ordinance that’s been on the books in San Francisco for years, one that strips public employees found guilty of "crimes of moral turpitude" against the city of their pensions. A recent court case involving a worker who stole from the city raised doubt about whether that law also applied to disability pay, and Prop. C would clear up that possible loophole.

But there are drawbacks this measure.

For starters, the problem isn’t that big: cases of rejected retirement benefits for city workers are rare. And the law still uses that questionable phrase "moral turpitude" — poorly defined in state law, never clearly defined in this measure, and as any older gay person can tell you, in the past applied to conduct that has nothing to do with honesty. The US State Department considers "bastardy," "lewdness," "mailing an obscene letter" and "desertion from the armed forces," among other things, to be crimes of moral turpitude.

Besides, Prop. C would apply not only to felonies but to misdemeanors. Cutting off disability pay for life over a misdemeanor offense seems awfully harsh.

The law that Elsbernd wants to expand ought to be rethought and reconfigured for the modern era. So vote no on C.

Proposition D

Appointments to city commissions

YES


Prop. D is a policy statement urging the mayor and the supervisors to appoint more women, minorities, and people with disabilities to city boards and commissions. It follows a study by the Commission on the Status of Women that such individuals are underrepresented on the policy bodies that run many city operations.

Despite the overblown concerns raised by local Republicans in the ballot arguments, this advisory measure would do nothing to interfere with qualified white males — or anyone else — getting slots on commissions.

Vote yes.

Proposition E

Board approval of San Francisco Public Utilities Commission appointees

YES


"The last thing we need is more politics at the San Francisco Public Utilities Commission," was the first line in Mayor Gavin Newsom’s ballot argument against Prop. E. That’s ironic: it was Newsom’s recent political power play — including the unexplained ousting of SFPUC General Manager Susan Leal and the partially successful effort to reappoint his political allies to this important body — that prompted this long overdue reform.

The SFPUC is arguably the most powerful and important of the city commissions, controlling all the vital resources city residents need: water, power, and waste disposal chief among them. Yet with the mayor controlling all appointments to the commission (it takes a two-thirds vote of the Board of Supervisors to challenge an appointment), that panel has long been stacked with worthless political hacks. As a result, the panel never pursued progressive approaches to conservation, environmental justice, public power, or aggressive development of renewable power sources.

Prop. E attempts to break that political stranglehold by requiring majority confirmation by the Board of Supervisors for all SFPUC appointments. It also mandates that appointees have some experience or expertise in matters important to the SFPUC.

If anything, this reform is too mild: we would have preferred that the board have the authority to name some of the commissioners. But that seemed unlikely to pass, so the board settled for a modest attempt to bring some oversight to the powerful panel.

Vote yes on Prop. E — because the last thing we need is more politics at the SFPUC.

Proposition F

Hunters Point-Bayview redevelopment

YES


Proposition G

NO


On the face of it, Proposition G sounds like a great way to restart the long-idle economic engine of the Bayview and clean up the heavily polluted Hunters Point Shipyard.

Who could be against a plan that promises up to 10,000 new homes, 300 acres of new parks, 8,000 permanent jobs, a green tech research park, a new 49ers stadium, a permanent home for shipyard artists, and a rebuild of Alice Griffith housing project?

The problem with Prop. G is that its promises are, for the most part, just that: promises — which could well shift at any time, driven by the bottom line of Lennar Corp., a financially stressed, out-of-state developer that has already broken trust with the Bayview’s low-income and predominantly African American community.

Lennar has yet to settle with the Bay Area air quality district over failures to control asbestos dust at a 1,500-unit condo complex on the shipyard, where for months the developer kicked up clouds of unmonitored toxic asbestos dust next to a K-12 school.

So, the idea of giving this corporation more land — including control of the cleanup of a federal Superfund site — as part of a plan that also allows it to construct a bridge over a slough restoration project doesn’t sit well with community and environmental groups. And Prop. G’s promise to build "as many as 25 percent affordable" housing units doesn’t impress affordable housing activists.

What Prop. G really means is that Lennar, which has already reneged on promises to create much-needed rental units at the shipyard, now plans to build at least 75 percent of its housing on this 770-acre waterfront swathe as luxury condos.

And with the subprime mortgage crisis continuing to roil the nation, there is a real fear that Prop. G’s final "affordability" percentage will be set by Lennar’s profit margins and not the demographics of the Bayview, home to the city’s last major African American community and many low-income people of color.

There’s more: The nice green space that you see in the slick Lennar campaign fliers is toxic and may not be fully cleaned up. Under the plan, Lennar would put condo towers on what is now state parkland, and in exchange the city would get some open space with artificial turf on top that would be used for parking during football games. Assuming, that is, that a deal to build a new stadium for the 49ers — which is part of all of this — ever comes to pass.

In fact, the lion’s share of a recent $82 million federal funding allocation will be dedicated to cleaning up the 27-acre footprint proposed for a new stadium. In some places, the city is planning to cap contaminated areas, rather than excavate and remove toxins from the site.

If the environmental justice and gentrification questions swirling around Prop. G weren’t enough, there remains Prop. G’s claim that it will create 8,000 permanent jobs once the project is completed. There’s no doubt that the construction of 10,000 mostly luxury homes will create temporary construction jobs, but it’s not clear what kind of jobs the resulting gentrified neighborhood will provide and for whom.

But one thing is clear: the $1 million that Lennar has already plunked down to influence this election has overwhelmingly gone to line the pockets of the city’s already highly paid political elite, and not the people who grew up and still live in the Bayview.

But there’s an alternative.

Launched as a last-ditch effort to prevent wholesale gentrification of the Bayview, Proposition F requires that 50 percent of the housing in the BVHP/Candlestick Point project be affordable to those making less than the median area income ($68,000 for a family of four).

That’s a reasonable mandate, considering that the city’s own general plan calls for two-thirds of all new housing to be sold or rented at below-market rates.

And if the new housing is built along Lennar’s plans, it will be impossible to avoid large-scale gentrification and displacement in a neighborhood that has the highest percentage of African Americans in the city, the third highest population of children, and burgeoning Latino and Asian immigrant populations.

Lennar is balking at that level, saying a 50-percent affordability mandate would make the project financially unfeasible. But if Lennar can’t afford to develop this area at levels affordable to the community that lives in and around the area, the city should scrap this redevelopment plan, send this developer packing, and start over again.

San Francisco has an affordable housing crisis, and we continue to doubt whether the city needs any more million-dollar condos — and we certainly don’t need them in a redevelopment area in the southeast. Remember: this is 700 acres of prime waterfront property that Lennar will be getting for free. The deal on the table just isn’t good enough.

Vote yes on F and no on G.

Proposition H

Campaign committees

NO


This one sounds just fine. Promoted by Mayor Gavin Newsom, Proposition H is supposedly aimed at ensuring that elected officials don’t solicit money from city contractors for campaigns they are sponsoring. But it lacks a crucial legal definition — and that turns what ought to be a worthy measure into little more than an attack on Newsom’s foes on the Board of Supervisors.

The key element is something called a "controlled committee." It’s already illegal for city contractors to give directly to candidates who might later vote on their contracts. Prop. H would extend that ban to committees, typically run for or against ballot measures, that are under the control of an individual politician.

Take this one, for example. Since Newsom put this on the ballot, and will be campaigning for it, the Yes on H campaign is under his control — he would be barred from collecting cash from city contractors, right? Well, no.

See, the measure doesn’t define what "controlled committee" means. So a group of Newsom’s allies could set up a Yes on H fund, raise big money from city contractors, then simply say that Newsom wasn’t officially aware of it or involved in its operation.

When Newsom first ran for mayor, the committee supporting his signature initiative — Care Not Cash — raised a fortune, and the money directly helped his election. But that wasn’t legally a "controlled committee" — because Newsom never signed the documents saying he was in control.

Prop. H does nothing to change that rule, which means it would only affect campaign committees that a politician admits to controlling. And guess what? Newsom almost never admits that, while the supervisors, particularly board president Aaron Peskin, are a bit more honest.

When Newsom wants to clearly define "controlled committee" — in a way that would have brought the Care Not Cash effort under the law — we’ll go along with it. For now, though, vote no on H.

San Francisco Democratic County Central Committee

The DCCC is the policy-making and operating arm of the local Democratic Party, and it has a lot of influence: the party can endorse in nonpartisan elections — for San Francisco supervisor, for example — and its nod gives candidates credibility and money. There’s been a struggle between the progressives and the moderates for years — and this time around, there’s a serious, concerted effort for a progressive slate. The Hope Slate, which we endorse in its entirety, has the potential to turn the San Francisco Democratic Party into a leading voice for progressive values.

There are other good candidates running, but since this group will have consistent support and is running as a slate, we’re going with the full crew.

13th Assembly District

Bill Barnes, David Campos, David Chiu, Chris Daly, Michael Goldstein, Robert Haaland, Joe Julian, Rafael Mandelman, Aaron Peskin, Eric Quezada, Laura Spanjian, Debra Walker

Superior Court judge, Seat 21

VICTORIA KOLAKOWSKI


There are two good candidates running for this open seat. Dennis Hayashi, a public-interest lawyer, would make a fine judge. Victoria Kolakowski would make history.

Kolakowski, who works as an administrative law judge for the California Public Utilities Commission, would be the first transgender person on the Alameda bench and, quite possibly, in the entire country. That would be a major breakthrough and important for more than just symbolic reasons: transpeople have extensive interactions with the judicial system, starting with the work to legally change their names; and, all too often, members of this marginalized community wind up in the criminal justice system. Having a sitting TG judge would go a long way toward educating the legal world about the importance of trans sensitivity.

Kolakowski is eminently qualified for the job: as a private intellectual property lawyer and later an ALJ at the CPUC, she’s handled a range of complex legal issues. She currently oversees administrative hearings that are very similar to court proceedings, and she has a calm and fair judicial temperament.

That’s not to denigrate Hayashi, who also has an impressive résumé. He’s spend much of his life in public-interest law, working for many years with the Asian Law Caucus, and he was co-counsel in the historic case that challenged Fred Korematsu’s conviction for refusing to report to a Japanese internment camp during World War II. He’s run the state’s Department of Fair Employment and Housing and was a civil rights lawyer in the Clinton administration.

We’d be happy to see either on the bench, but we’re going to endorse Kolakowski.

Board of Supervisors, District 5

KEITH CARSON


Keith Carson, the leading progressive on the board, has no real opposition this time around. He’s been a voice for protecting the fragile social safety net of the county, and we’re happy to endorse him for another term.

Oakland races

City Attorney

JOHN RUSSO


John Russo, who has made no secrets of his political ambition, failed in a bid to win the State Assembly seat for District 16 in 2006, and now he’s running unopposed for reelection. Russo has voiced some pretty ridiculous sentiments: he told a magazine for landlords in May 2006 that he opposed all forms of rent control and was against laws requiring just cause for evictions. That’s a horrible stand for a city attorney to take in a city with a huge population of renters. But Russo is smart and capable, and he’s one of the few city attorneys who consistently supports sunshine laws. We’ll endorse him for another term.

City Council, District 1

JANE BRUNNER


An attorney and former teacher, Jane Brunner spends a lot of time pushing for more cops; crime is the top issue in the North Oakland district she represents. And while we’d rather see anticrime approaches that go beyond hiring more officers, we appreciate that Brunner takes on the police department over its hiring failures. We also find her far more preferable on the issue than her opponent, Patrick McCullough, a longtime neighborhood activist who has become something of a celebrity since he shot a teenager who was hassling him in front of his house in 2005.

Brunner is one of the council’s strongest affordable housing advocates and has worked tirelessly for an inclusionary housing law. She deserves reelection.

City Council, District 3

NANCY NADEL


Nadel is hardworking, effective, a leader on progressive economic and planning issues, and one of the best members of the Oakland City Council. She asked the hard questions and demanded improvements in the giant Oak to Ninth project (although she wound up voting for it). She’s pushing for better community policing and promoting community-based anticrime efforts, including a teen center in a part of her district where there have been several homicides. She was a principal architect of the West Oakland industrial zoning plan, which she hopes will attract new jobs to the community (although she also pissed off a few artists who fear they’ll be evicted from living spaces that aren’t up to code, and she needs to address the problem). We’re happy to endorse her for another term.

City Council, District 5

MARIO JUAREZ


Somebody has to try to oust Ignacio De La Fuente, and this time around, Juarez is the best bet. A small-businessperson (he runs a real-estate operation with around 60 employees), he has some surprisingly progressive positions: he not only supports inclusionary housing but told us that he wanted to see the percentage of affordable units increased from 15 to 25 percent. He wants to see community policing integrated fully into Oakland law enforcement. He suggested that Oakland look into putting a modest fee on all airport users to fund local education. And he’s in favor of stronger eviction controls and tenant protections.

De La Fuente, the City Council president, has been the developers’ best friend, has run meetings with a harsh hand, often cutting off debate and silencing community activists, and needs to be defeated. We know Juarez isn’t perfect, but his progressive grassroots-based campaign was strong enough to get him the nod of both the Democratic Party and the Alameda County Greens. We’ll endorse him, too.

City Council, District 7

CLIFFORD GILMORE


Neither of the candidates in this race are terribly impressive, but incumbent Larry Reid has been so terrible on so many issues (supporting big-box development, inviting the Marines to do war games in Oakland, supporting condo conversions, etc.) that it’s hard to imagine how Clifford Gilmore, director of the Oakland Coalition of Congregations, could be worse.

City Council, at large

REBECCA KAPLAN


Rebecca Kaplan is exactly what the Oakland City Council needs: an energetic progressive with the practical skills to get things done. As an AC Transit Board member, she pushed for free bus passes for low income youths — and defying all odds, managed to get all-night transit service from San Francisco to the East Bay. She did it by refusing to accept the conventional wisdom that transit agencies on the two sides of the bay would never cooperate. She put the key players together in a meeting, convinced the San Francisco supervisors to allow AC Transit buses to pick up passengers in the city late at night, and put through an effective program to get people across the bay after BART shuts down.

Kaplan is running for City Council on a progressive platform calling for affordable housing, rational development, and community policing. Her latest idea: since Oakland has so much trouble attracting quality candidates for vacancies in its police department, she suggests the city recruit gay and lesbian military veterans who were kicked out under the Pentagon’s homophobic policies. Her proposed slogan: "Uncle Sam doesn’t want you, but Oakland does."

Vote for Rebecca Kaplan.

School Board, District 1

JODY LONDON


The Oakland schools are still stuck under a state administrator; the district, which was driven by mismanagement into a financial crisis several years ago, paid the price of a state bailout by giving up its independence. The school board has only limited authority of district operations, though that’s slowly changing. The state allowed the board to hire an interim superintendent, meaning issues like curricula and programs will be back under local control. So it’s a time of transition for a district that has had horrible problems, and the board needs experienced, level-headed leadership.

We’re impressed with Jody London, a parent with children in the public schools who runs a small environmental consulting firm. She has been active in the district, co-chairing the 2006 bond campaign that raised $435 million and serving on the bond oversight committee. She has a grasp of fiscal management, understands the challenges the district faces, and has the energy to take them on.

Her main opposition is Brian Rogers, a Republican who has the backing of outgoing state senator Don Perata and is a big fan of private charter schools. Tennessee Reed, a young writer and editor, is also in the race, and we’re glad to see her getting active. But on balance, London is the clear choice.

OLUBEMIGA OLUWOLE, SR.


Not a great choice here — we’re not thrilled with either of the two contenders. Jumoke Hinton Hodge, a nonprofit consultant, is too willing to support charter schools. Oluwole, who works with parolees, has limited experience with education. But on the basis of his community background (he’s on the board of the Oakland Community Organization) and our concern about Hodge and charter schools, we’ll go with Oluwole.

Noel Gallo, the incumbent, is running unopposed. He’s been a competent member of the board, and we see no reason not to support his reelection.

But her main opponent, Doris Limbrick, is the principal of a Christian school and has no business running for the board of a public school district. So we’ll go with Spearman again.

Measure F extends and slightly increases the utility tax on unincorporated areas of the county. It’s not the greatest tax, but it’s not terrible — and it provides essential revenue to pay for services like law enforcement, libraries, and code enforcement. The parts of Alameda County outside any city boundary have been dwindling as cities expand, but the county provides the only local government services in those areas. And, like every other county in California, Alameda is desperately short of cash. So Measure F is crucial. Vote yes.

Measure J would update a 40-year-old tax on phone use that goes for local services. The tax law applies only to old-fashioned land lines, so cell phone users get away without paying. This isn’t the world’s most progressive tax, but Oakland needs the money and Measure J would more fairly share the burden. Vote yes.

The fourth floor of San Francisco’s City Hall feels remote. Dimly lit and strangely quiet, it conveys a sense of isolation from the powerful people who do their work in the lower levels of the building.

Here, in an unremarkable conference room, is where the San Francisco Peak Oil Preparedness Task Force is conducting its second meeting. Two of its officers are absent, and only one member of the public has turned up to participate. It is an atmosphere that belies the issue’s cataclysmic potential.

The day’s breaking news headlines of oil reaching $100 per barrel for the first time in history is perhaps a harbinger of things to come. One year earlier the price was $58 per barrel. This dramatic increase in such a short span would devastate economies around the world if it continued at anywhere close to that rate.

Chairperson Jeanne Rosenmeier, an articulate, contemplative woman, reiterates the task force’s purpose: "Our charge is to examine how the city is going to handle rising oil prices and possible shortages. That is what we have been asked to do."

The assessment seems like an understatement, perhaps suggesting that the group is merely looking for solutions to how the average citizen could function better without an automobile. Yet in a society built on oil, the consequences of such an energy crisis are likely to be far more sweeping and problematic than merely high gas prices.

While considering models for the study the task force will prepare, Rosenmeier points to Portland, Ore.’s recently completed peak oil report and talks about limiting San Francisco’s effort to outlining the range of scenarios, from small impacts to large. She’s reluctant to acknowledge the extralarge scenario — massive worldwide social unrest and full-scale anarchy in the streets of San Francisco — which she argues would be harmful to the group’s focus.

Jan Lundberg, the task force member in charge of "societal functioning," politely disagrees. Insightful and exuding a sort of deeply ingrained experience, Lundberg has a goatee and a big mane of blond hair that make him look like a Berkeley-ish version of billionaire Virgin CEO Richard Branson. The resemblance is strangely apt when you consider that Lundberg has defected from more lucrative ventures. His family’s business, the Lundberg Survey, has been one of the premier oil industry research authorities in the world for the past few decades, but today Lundberg is volunteering his time to the task force.

"You have to look honestly at what we are up against," Lundberg tells the Guardian. "Only then can you come up with intelligent responses to what is occurring. If it is a tsunami coming, then you take action for a tsunami."

It might come as news to most San Franciscans that a team of seven relatively unknown, politically appointed volunteers is hashing out the hard realities and dire implications of a potentially massive energy crisis. When the Board of Supervisors unanimously passed a resolution (with Sup. Michela Alioto-Pier absent) in April 2006 to acknowledge the looming phenomenon of the global oil supply being exceeded by demand, San Francisco was the first city in the country to do so. It was a precedent that received little attention from the media, perhaps shrugged off as just another wacky resolution steeped in San Francisco values.

For the next 10 months the task force will be preparing a study of mitigation measures to be considered by the city government for implementation into law. Much like the phenomenon of peak oil, their work will also be best assessed in hindsight. For now, some will see them as a team of Chicken Littles sketching a contingency plan for when the sky falls.

Yet if the scientific insights that compelled the Board of Supervisors to form the group prove prescient, then the report that the task force is producing may well be crucial to San Francisco’s very survival.

SLIPPERY SLOPE


Oil has acquired a bad reputation in recent years, as if the resource were not a fossil fuel found in the earth’s crust but a corrupt corporate tycoon spurring international conflicts and gleefully dismantling the ozone layer. Like addicts who blame the substance rather than the habit, we have come to forget that oil is one of the best resources the planet has offered.

"Oil is amazing stuff. The 20th century was basically founded on the wonders of petroleum," explains Richard Heinberg, a professor at New College of Santa Rosa and author of several books, including The Party’s Over: Oil, War and the Fate of Industrial Societies (New Society Publishers, 2003). "Oil is very energy dense and can be made into an amazing range of chemicals and products. Our entire way of life is soaked in petroleum," he says.

This point tends to get lost in the shuffle. It is often forgotten that more than just powering our cars, petroleum is deeply woven into the fabric of our daily lives. Adding up to a global consumption rate of about 86 million barrels per day, oil plays a starring role in agriculture, industry, infrastructure, and transportation. It heats our homes, paves our roads, and grows our food.

So what happens when the global demand for oil begins to outpace the supply? That’s the peak oil question.

"Peak oil is not theoretical. Everyone knows that oil is a nonrenewable resource," Heinberg explains, "so at some point our ability to continue increasing the supply will cease. Everyone knows that it will happen. It is just a matter of when."

Peak oil is inherently a geological concept, formulated by renowned geophysicist Marion King Hubbert. In 1956, as a researcher for Shell Oil, Hubbert presented his theory to the American Petroleum Institute, claiming that the oil output in the mainland United States would peak in the late 1960s or early ’70s. Though dismissed by his colleagues at the time, Hubbert was vindicated when US oil production peaked in 1970 and the nation became forever dependent on foreign sources of petroleum to meet its energy needs.

Hubbert had explained that the production of any petroleum reserve — a single oil well, a particular country, or even the entire planet — follows a similar bell-shaped curve (now referred to as the Hubbert curve). The logic is that as the supply is first tapped, there is a steady increase of oil output that ascends to a peak (or plateau), which represents the maximum amount of oil that will ever be produced from the designated source. As production descends the other side of the curve, the supply is not exhausted, but future yields will always be lower and more expensive to obtain.

For the past 10 years — as the price of crude oil has gone from $12 to $100 per barrel on the world market — scientists, geologists, petroleum experts, and concerned citizens have increasingly pondered the point at which the global oil supply will not only begin to wane but fail to keep up with surging demand.

Proponents of preparing for the impending peak in worldwide petroleum output often cite the steady decline of major oil field discoveries since the 1960s and the alarming number of oil-producing countries that have already hit their peaks. Considering the widespread role petroleum plays in the general day-to-day functioning of our society, an impending decline in overall global production is — to put it mildly — severely worrying.

"People assume that the other side of the peak will be an orderly transition," Lundberg tells us, "but we have no other experience to compare it to."

In 2005 the United States Department of Energy completed a study it had commissioned on the topic of worldwide petroleum depletion titled Peaking of World Oil Production: Impacts, Mitigation, and Risk Management. Popularly known as the Hirsch Report (for principal author Robert Hirsch), the study consulted a wide range of scientific and oil industry experts.

It painted a startling portrait: "The peaking of world oil production presents the U.S. and the world with an unprecedented risk management problem. As peaking is approached, liquid fuel prices and price volatility will increase dramatically, and, without timely mitigation, the economic, social, and political costs will be unprecedented. Viable mitigation options exist on both the supply and demand sides, but to have substantial impact, they must be initiated more than a decade in advance of peaking."

"It is one of the most important government reports of the last half century," Heinberg explains, "because it clearly indicates that this global event of peak oil is going to change everything."

Unfortunately, the Hirsch Report has been mostly ignored by Congress, the George W. Bush administration, and the DOE itself (which did not even publish the study for more than a year after its completion). However, the most troublesome aspect of the report is the fact that a sizable selection of the scientists and activists concerned with the topic believe that we’ve already hit the peak. They believe peak oil is happening right now.

PITCHING THE PEAK


"Most people in this country are energy illiterate," David Fridley says. "We can’t substitute millions of years of fossil fuels with something that we can manufacture in a factory, like biofuels. So most people don’t get this sense of anxiety about the situation we’re in."

Fridley knows a fair amount about energy. Currently a staff scientist leading the China Energy Group of the Lawrence Berkeley National Laboratory, he has spent a large portion of his career working in the Asian oil industry. His deep concern over the implications of peak oil incited him to play a key role in the formation of San Francisco’s task force.

"Having spent a year just thinking about this on my own," Fridley tells us, "and everyone around me telling me I was nuts, I decided to join a local group where I could at least meet up with others and see if we might educate people rather than just talking amongst ourselves."

In 2005, Fridley met Dennis Brumm — a veteran San Francisco activist with an address book containing an A-list of the city’s prime political players — who was looking to raise the city’s awareness of the issue.

Together with local activists Jennifer Bresee and Allyse Heartwell, they set their sights on bringing the issue of peak oil before the Board of Supervisors.

"Tommi Avicolli Mecca of the Housing Rights Committee is a friend of mine," Brumm explains, "so I invited him over to my house one night and had him discuss with us the personalities and quirks of the supervisors and their aides."

Having charted the terrain, Brumm’s small group soon began spending its Thursdays and Fridays for the next six months lobbying the supervisors at City Hall. When technical questions were asked, the group referred to Fridley’s decades-long experience in the industry for expert scientific analysis.

In April 2006, with backing from District 5 Sup. Ross Mirkarimi and District 1 Sup. Jake McGoldrick, the board passed Resolution Number 224, recognizing "the challenge of Peak Oil and the need for San Francisco to prepare a plan of response and preparation."

For Fridley, the resolution and the formation of the task force were matters of appropriate preparation. "We have two oil tankers come under the Golden Gate every day to fill up the local refinery tanks to produce the fuels that keep the Bay Area running," he says. "What would happen if those tankers don’t come in? Or they don’t come for a week? The city has no plan for that, but we have the ability to be better prepared."

HALF EMPTY OR HALF FULL?


When discussing the phenomenon of peak oil, Lundberg prefers to use the term petro collapse. It is a turn of phrase that quickly provides insight into his considerable sense of alarm for the days ahead.

"It is going to be a globally historic event," Lundberg says. "Imagine a nationwide version of [Hurricane] Katrina."

Although ominous in its predictions, Lundberg’s perspective is based on a long road of experience. While he ran the Lundberg Survey with his father in the 1970s, their widely read insider journal for the oil industry predicted the second great oil shock of the decade (in 1979). In the mid-1980s he moved on from the family business to form the Sustainable Energy Institute nonprofit in Washington DC, a move USA Today marked with the headline "Lundberg Goes Green."

As suggested by the title of the online magazine he currently edits — Culture Change — Lundberg has come to view the peak oil phenomenon as being primarily an issue of the American consumer lifestyle.

"We have this crazy way of life based on limited resources that are clearly becoming constrained," he says, "and we’re holding on to yesterday’s affluence without realizing that we have already walked off the cliff."

Chairperson Rosenmeier, one of Lundberg’s colleagues on the task force, is wary that such an explicitly bleak viewpoint may scare public attention away from the matter.

"You have to be careful with peak oil that you don’t immediately leap to ‘We’re all doomed and our economy is doomed,’<0x2009>" she says. "I think there is an intermediate phase, which is what we are being asked to address: the transition from business as usual."

An accountant by trade and a longtime Green Party activist, Rosenmeier ran for state treasurer in 2002, garnering about 350,000 votes. Setting an ambitious pace for her contribution to the report, she recently met with the Mayor’s Office of Economic and Workforce Development to request an analysis of how oil prices are related to the orientation of San Francisco’s economy. For this reason, she appears less concerned with predictions than with producing a heavily researched and well-structured report.

"I have a very strong vision of what I want the report to look like," Rosenmeier says. "I want us to have a uniformity and a more quantitative approach. I do not want to address the disintegration of our society."

The disparity between the views of Lundberg and Rosenmeier reflects the vast spectrum of opinions on how peak oil will manifest, although the extremes go well beyond them: some call peak oil a liberal hoax, while others have converted all of their assets to gold and prepared well-stocked and well-armed bunkers where they can ride out the social and economic storm.

The Web site LifeAfterTheOilCrash.net is now getting as many as 23,000 hits per day. Creator Matt Savinar, a graduate of the University of California Hastings College of the Law, abandoned his law career as a futile concern when compared to the implications of peak oil.

"It is pretty simple," Savinar tells us. "What do you think is going to happen when the oil-exporting countries like Russia, Venezuela, and Iran say, ‘We cannot export any more because we need to keep it for our own people’? The US will react by starting a war."

Although Savinar gravitates toward the most drastic of peak oil’s potential implications, his concerns are shared by some high-profile figures. Rep. Roscoe Bartlett (R-Md.), who has started the small but significant Peak Oil Caucus in Congress, has quoted Savinar’s work in congressional session, while billionaire Richard Rainwater told Fortune magazine he regularly reads Savinar’s site.

Pessimistic about the prospect of mitigating the effects of peak oil, Savinar characterizes the efforts of the San Francisco Peak Oil Preparedness Task Force as "throwing a wet rag at a forest fire." In swinging to the opposite end of the spectrum, the vast chasm between opinions on the matter manifests more clearly. Peter Jackson, the senior director of oil industry activity for the Cambridge Energy Research Associates, recently published the results of an in-depth analysis of more than 800 oil fields worldwide, concluding that the declining output rate of established fields is about half as low as originally expected.

"I think the danger of a peak [in global oil production] in the short term is minimal," Jackson tells the Guardian. "I think there are plenty of new developments on the books of oil companies, and the prospects for growth are good."

While Jackson acknowledges that at some point in the future it will be difficult to increase production, his optimistic viewpoint of the current situation helps to flesh out the dynamics of the overall discussion. As Heinberg explains it, "The debate really is between the near-peak and the far-peak viewpoints."

Yet even as Jackson attracts the ire of near-peak proponents such as Heinberg, he still acknowledges the need for swift preparation efforts. "There is still time to think about these issues and plan for the future," Jackson says. "But the sooner we do that the better."

EATING OIL, GROWING FUEL


Toward the end of the task force’s most recent meeting, the group discusses the city’s potential options for producing its own food supply. As Lundberg points out some of the particulars for pulling up pavement to plant crops, the exchange seems like an excerpt from Ernest Callenbach’s novel Ecotopia (Bantam, 1990).

"Streets cannot be pulled up as easily as driveways or parking lots," Lundberg explains. "There is soil immediately below a concrete driveway, whereas the earth beneath a street is much farther down."

This talk of tearing up asphalt to transform the city’s urban landscape into a viable agricultural venture may seem strange, until one considers how overreliant modern agribusiness has become on cheap fossil fuels.

"About one-fifth of all the petroleum we use goes into some part of our agriculture system," explains Jason Mark, the task force member focusing on the city’s food supply. "Whether that is through transportation and shipping, tractors and farm machinery, or the making of synthetic fertilizers and pesticides — it all demands oil."

Mark notes that the average American meal travels an estimated 1,500 miles from the farm to the dinner table, a startling figure that can be partly attributed to federal policies like the North American Free Trade Agreement that have encouraged export crops rather than diversified farming for local consumption.

"There is no way that San Francisco is going to feed itself in the short term," Rosenmeier says. "Food is going to be a gigantic issue."

In a larger sense, it already is. This past December the Food and Agricultural Organization of the United Nations urged governments to take immediate steps to mitigate "dramatic food price increases" worldwide. Meanwhile, a recent cover story in the New York Times ("A New, Global Quandry: Costly Fuel Means Costly Calories," 1/19/08) cited "food riots" in more than half a dozen countries and asserted, "Soaring fuel prices have altered the equation for growing food and transporting it around the world."

In the US, the Department of Labor’s Consumer Price Index cited a 5.6 percent increase of national grocery store prices in 2007, echoing sizable domestic price spikes in milk, corn, and wheat supplies.

"In a situation where you have sharp increases in the price of fossil fuels, you are going to see spikes in the costs and perhaps even the availability of food," explains Jason Mark, a former employee of Global Exchange and a graduate of the University of California at Santa Cruz’s renowned ecological horticulture program.

Mark now splits his time between editing the environmental quarterly Earth Island Journal and comanaging Alemany Farms. In his task force research, Mark plans to focus on two key challenges: increasing food production within San Francisco and improving both production in and distribution from the farms in the Bay Area.

"The city is pretty lucky because we are surrounded by all of this incredibly productive agricultural land," Mark explains. "If you were to draw a 100-mile radius around Potrero Hill, you could still have a pretty amazing diet."

Of course, the situation is far from simplistic. Climate change has proven to be a wild card in the equation, periodically negating dependable food supplies. Most recently, the entire Australian wheat crop collapsed due to a massive drought, affecting food imports around the world.

Less noticeable, though equally problematic, is the strain that biofuels are putting on food supplies. As increases in oil prices are stimuutf8g demands for alternatives, governments must decide whether crops should be used as food or fuel.

"Increasing our production of ethanol or biodiesel means direct competition with the food supply," Heinberg says. "In other words, we may see millions of people around the world going hungry so that a small percentage of the population can continue to drive their cars."

While such factors translate into a predicament as delicate as it is complex, Mark manages to elude pessimism. "I’m not one of these apocalyptic fetishists inciting for some sort of Mad Max scenario," he explains. "[The task force] is going to come out with a document that, although cautionary in scope, will be really optimistic about how SF can exist as an oil-free city."

GLOBAL WARNING


Amid a vast disparity of opinions from scientists and industry experts expounding both sides of the debate, the San Francisco Peak Oil Preparedness Task Force plans to release its final report in October.

As with the issue of climate change almost two decades ago, the task force members face a long climb toward making an impression on an American population that has shown considerable reluctance to alter its lifestyles.

And while the deliberation over the onset of peak oil is likely to see little decline among skyrocketing energy costs and increasing geopolitical hostilities, the underlying truth may already be far less complicated.

"The era of cheap oil is over," Lundberg says. "Period." *

OIL ALTERNATIVES

In the event of sudden petroleum shortages, how do the alternatives stack up?

Ethanol: The Republican choice for weaning the nation off oil is a lucrative venture for red state constituents in the Midwest. However, the drawbacks are numerous. Corn ethanol requires almost as much oil energy to produce as it is meant to replace. Furthermore, it will require 4.8 billion — yes, billion — acres of corn to match the world’s current rate of annual oil consumption.

Hydrogen fuel cells: Touted by conservatives as some kind of miracle fuel because its tailpipe by-product is simply water vapor, hydrogen is a long way from being a viable fuel for cars, if that’s even possible. It takes even more energy to produce than ethanol and can explode in collisions.

Nuclear: Expensive and unpopular, nuclear power faces numerous logistical hurdles (particularly safety and long-term waste storage) that make it infeasible in the short and middle terms.

Natural gas: A major source of current United States energy consumption (25 percent nationally), natural gas is extremely difficult to ship, making importation from far-off sources impractical. Its supplies are running low in the US, and this nonrenewable fossil fuel is likely to parallel oil in its decline.

Wind: This clean power source is being quickly developed around the world as a major generator of electricity. Currently in the US, it accounts for about 1 percent of domestic electricity production, so offsetting the loss of fossil fuel plants would require a massive commitment. Downsides include the danger to migrating birds and the fact that sometimes the wind doesn’t blow.

Solar: This is Marion King Hubbert’s choice for replacing fossil fuels. It is a renewable generator of electricity, yet the shortcomings so far have been with finding more efficient and less toxic battery technology to store it. But improving research and strong consumer demand for solar panels point to a promising future.

Showdown at 55 Laguna

Time is running out on attempts by Sup. Ross Mirkarimi, State Sen. Carole Migden, and Assemblymember Mark Leno to secure greater affordable-housing levels from the University of California, which wants to build private residential units on its UC Berkeley Extension campus at 55 Laguna in San Francisco.

Since the school site closed more than three years ago, critics have questioned how the UC’s plan for the campus, which served a public use for more than 150 years, will benefit the community, while preservationists succeeded in getting the campus awarded historic landmark status.

But with the UC claiming "unrestricted power to take and hold real and personal property for the benefit of the university" in a public statement, the city’s regulatory power is limited. The San Francisco Planning Commission is scheduled to consider the project Jan. 17, including the demolition of Middle Hall Gymnasium, the oldest building on the campus, and Richardson Hall Annex. But local and state legislative officials are focused on trying to get more affordable housing at the site.

Although negotiations were still ongoing at Guardian press time, the UC’s plan was to demolish the two historically landmarked buildings on the 5.8-acre Hayes Valley campus and build 450 new housing units, 16 percent of them to be offered below market rates, about the minimum number under the city’s inclusionary-housing law.

"But we’re pushing hard at the bottom line," said Mirkarimi, who, along with Migden, Leno, the city’s Planning Department, the Mayor’s Office of Housing, and affordable-housing activists, has been meeting with developer A.F. Evans and Openhouse, a local nonprofit that intends to build an 80-unit, market-rate, LGBT-friendly, senior residential community on the site.

"And we are trying at a separate venue to appeal to the UC Regents to be more sensitive and cooperative in what their bottom line profitability level is," Mirkarimi, whose District 5 includes Hayes Valley, told the Guardian.

Mirkarimi said he’s in favor of preserving all five buildings at the site but that both the Planning Commission’s Landmark Advisory Committee and the Board of Supervisors have voted to preserve only three. "We are trying to be pragmatic yet clear as to what our objectives are in trying to make a complex deal that’s triangulated by UC Berkeley, A.F. Evans, and Openhouse, with UC as the big daddy in the room.

"UC can do almost what UC wants. But the city’s leverage comes from UC asking for housing to be built and requesting a zoning change at a site that has become a magnet for grime and crime," Mirkarimi said. "It would also be negligent for UC to let this site remain in its current condition.

Under state law, the UC is exempt from city and county zoning and building codes if it builds educational facilities or projects that are deemed to be in the public interest. But according to officials with the City Attorney’s Office, the UC is not exempt from such codes if it turns over its land for private development.

And then there’s the city’s claim that it never conveyed the title to Waller Street, which lies between Buchanan and Laguna streets and is essential to the project, giving opponents some leverage. The UC disputes the city’s claim, but Mirkarimi maintains that the Board of Supervisors’ control of the street "provides a contingency plan if we are not making progress. And either way, UC is going to have to pay for the right to Waller."

The UC’s 55 Laguna project manager Kevin Hufferd confirmed that he is having "ongoing discussions with state and city officials" but declined to comment further.

"Frustrating" is how queer affordable-housing activist Tommi Avicolli Mecca described the last-minute discussions about the 55 Laguna development plan. "A.F. Evans claims it won’t be making any money and that they can’t do any more," Mecca told the Guardian. He attended a Jan. 11 meeting with the company at which, he claims, the developers offered to increase affordability levels to 19.5 percent but Mirkarimi pushed for more.

"To his credit, Sup. Ross Mirkarimi keeps saying this is unacceptable," Avicolli Mecca said, also lauding the Mayor’s Office of Housing for trying to make Openhouse’s project "100 percent affordable."

Currently, Openhouse’s development includes no below-market-rate units, a situation Avicolli Mecca claims the MOH hopes to change "through bringing in subsidies."

"Obviously, we are not against queer senior housing," Avicolli Mecca said. "The issue is that this is a lousy deal. What are we getting? Nothing, but UC gains a lot of money. There’s a crazy need for affordable housing and no way to justify this plan."

Filmmaker Eliza Hemingway, whose documentary Uncommon Knowledge records how the UC shuttered 55 Laguna with no input from — and little concern for — staff, students, and the surrounding community, believes that people have lost sight of the public use issue.

"They are worn down by the struggle, by trying to find a compromise because the space is empty, but the question remains: why is a public campus being privately developed?" Hemingway told us. She mourns the loss of educational programs and spaces that benefited the community and the lack of transparency that has marred the UC’s plans.

"For there to have been such huge barriers to the public process over what is a huge amount of public land is unfortunate," Hemingway said.

Cynthia Servetnick of the Save the UC Berkeley Extension Laguna Street Campus told us her group is prepared to file a lawsuit under the California Environmental Quality Act if the project as currently proposed is approved.

"We’d rather see a project that has 40 percent affordable housing at 50 percent [area median income] than a lawsuit, but $38,000 a year [which would be the annual income requirement for seniors, the disabled, and people with AIDS to be able to afford one of Openhouse’s units] is too high," she said, noting that the proposed units are small but could go for $4,000 a month, rising to $7,000 monthly for those who need more services and staff.

Claiming that recognition of the campus as a historic landmark assists project sponsors in accessing preservation incentives, including federal tax credits, Servetnick said, "A.F. Evans has its [environmental impact report] complete and is clearing the way for 450 units, but they could do that and save all the historic buildings, thus having the same profitability but more affordability. It’s now or never. This is a new term for the mayor, we have a new city planning director, John Rahaim, and officials open to negotiating a win-win."

Migden was even more blunt. "Poor old queers need a place to retire too," she said. "Either Evans and the UC up the affordability level to 40 or 50 percent and guarantee that some of the senior LGBT units are subsidized, or the project dies."

As of press time, A.F. Evans, Openhouse, the SF Planning Department, and UC representatives had not returned the Guardian‘s calls.

Deferring to Mirkarimi to make an official announcement, Leno said, "I know that the meetings have been ongoing and that the issue of affordability is a priority, and I’m hopeful that we will have an agreement among all stakeholders shortly."

The San Francisco Ethics Commission is at an important crossroads, facing decisions that could have a profound impact on the city’s political culture: should every violation be treated equally or should this agency focus on the most flagrant efforts to corrupt the political system?

The traditionally anemic agency that regulates campaign spending is just now starting to get the staff and resources it needs to fulfill its mandate. But its aggressive investigation of grassroots treasurer Carolyn Knee (see “The Ethics of Ethics,” 7/4/07) — which concluded July 9 with her being fined just $267 — is raising questions about its focus and mission.

“For the first time in our history, we’re having growing pains,” Ethics Commission executive director John St. Croix told the Guardian, noting that the agency’s 16 staffers (slated to increase to 19 next year) are double what he started with three years ago.

Reformers like Joe Lynn — a former Ethics staffer and later a commissioner — say the commission should do more to help small, all-volunteer campaigns negotiate the Byzantine campaign finance rules, be more forgiving when such campaigns make mistakes, and focus on more significant violations by campaigns that seek to deceive voters and swing elections.

“The traditional thinking is there’s no exception to the law, and that’s been my traditional thinking too,” Lynn said. “But it doesn’t cut the mustard when you see a Carolyn Knee say, ‘I’m not going to do that again.'<\!s>”

At Knee’s June 11 hearing, Doug Comstock — who often does political consulting for small organizations — urged commissioners to reevaluate their mission. “Why are you here?” he asked them. “You’re not here to pick on the little guys.”

Yet St. Croix told us, “That’s not really the way the law is written. Everybody is supposed to be treated the same…. The notion that the Ethics Commission was only created to nail the big guns is not correct.”

That said, St. Croix agrees that regulators should be tougher on willful violators and those who have lots of experience and familiarity with the rules they’re breaking. And he said they do that. But it’s the grassroots campaigns that tend to have the most violations.

“It’s frustrating because the people who make the most mistakes are the ones with the least experience,” St. Croix said, noting that the commission can’t simply ignore violations.

 

A MATTER OF PRIORITIES

But critics of the commission say the problem is one of priorities. Even if there were problems with Knee’s campaign, there was no reason the commission should have launched such an in-depth and expensive investigation four years after the fact. That decision was recently criticized in a resolution approved by the San Francisco Democratic County Central Committee, which argued that the approach discourages citizens from getting politically involved.

“[The] San Francisco Ethics Commission spends an inordinate amount of its meager resources in pursuing petty violations allegedly committed by grassroots campaigns; this disproportionate enforcement against grassroots campaigns is directly contrary to the goal of the Campaign Finance Reform Ordinance,” one “whereas” from the resolution read.

The resolution’s principal sponsor, Robert Haaland, is intimately familiar with the problem. When he ran for supervisor in District 5 two years ago, his treasurer had a doctorate from Stanford and still struggled to understand and comply with the law. But they made a good-faith effort, he said, and shouldn’t be targeted by Ethics.

“It’s sort of like the IRS going after the little guy,” Haaland told us. “The commissioners need to set the direction of the commission for where they’re spending their time and resources.”

Eileen Hansen is perhaps the only member of the five-person commission to really embrace the idea that its mission is to help citizen activists comply with the law and to go after well-funded professionals who seek to skirt it. To do otherwise is to harm San Francisco’s unique grassroots political system.

“It’s true, the law is the law,” Hansen told us. “But I do think the Ethics Commission needs to grapple with how to apply the law in a fair manner.”

Is it fair to apply the same standard to Knee and to the treasurer of the campaign on the other side of the public power measure she was pushing, veteran campaign attorney Jim Sutton, whose failure to report late contributions from Pacific Gas and Electric Co. later triggered a $240,000 fine by Ethics and the California Fair Political Practices Commission, while those contributions might have tipped the outcome of the election?

Sutton gets hired by most of the big-money campaigns in town, such as Mayor Gavin Newsom’s, and has a history of skirting the law, including a recent case of allegedly laundered public funds at City College; coordination of deceptive independent expenditures against Supervisors Chris Daly, Gerardo Sandoval, and Jake McGoldrick; District Attorney Kamala Harris’s violation of her spending-cap pledge in 2003; and an apparent attempt to launder inaugural-committee funds to pay Newsom’s outstanding campaign debts (see “Newsom’s Funny Money,” 2/11/04). Yet the practice of the commission is to ignore that history and treat Sutton, who did not return calls seeking comment, the same as everyone else.

“We all admire and want grassroots organizations to do what they need to do,” Commissioner Emi Gusukuma said. But, she said, “the laws are there for a reason…. We’re supposed to enforce and interpret the law. The law should only apply to big money? The law has to apply to everybody. We can’t pick or choose.”

David Looman, a campaign consultant and treasurer involved in dozens of past elections, put it wryly. “Some people talk as though the grassroots campaigns shouldn’t have to obey the law,” he said of some activists he’s worked for who consider themselves the good guys. He said he reminds them, “This is the act that you helped pass, and now you gotta abide by it.”

“But there ought to be some kind of business sense here. Most regulatory agencies have offenses which they regard as de minimis,” Looman said, meaning “you get a nasty letter that says, ‘Don’t make a habit of it,’ and when you do make a habit of it, stricter penalties come into play.”

His experience with the commission has led him to believe there’s no sense of priorities when it comes to what Ethics pursues. Many of the small campaign committees Looman represents have been audited to what he feels is a ridiculous extent.

In one case, he told us, he took over the management of the Bernal Heights Democratic Club and discovered that it hadn’t been filing certain documents for years. He ended up paying $10,000 out of his own pocket to cover Ethics fines just because his name was now on the dotted line.

“Yes, the Bernal Heights Democratic Club was in complete violation of the law. They deserved to pay a penalty, but it was so far out of proportion. It was two times our yearly income. I think that’s inappropriate,” Looman told us.

 

THE GRASSROOTS CULTURE

Some say the whole idea of local campaign reform is to nurture an important and unique aspect of San Francisco: its vibrant and diverse grassroots political culture. “For every two committees in LA, there are three in San Francisco,” Lynn said, adding that it used to be a more extreme, two-to-one ratio. Larger cities often have more professionals involved, he said. “San Francisco has a unique political culture, very heavy on the grass roots.”

Yet the Ethics Commission doesn’t see protection of the little person as part of its mission.

“The fundamental problem with Ethics is it is not staffed by people who have been advocates for good government reforms,” Lynn said. “The Ethics Commission needs to come to grips with the fact that they’re tampering with the grassroots political culture of San Francisco.”

Lynn would like the commission to direct some resources toward hiring assistants to staff the office during the two or three weeks prior to Election Day, a crew that would help prevent violations and inoculate campaigns against being fined for errors that do occur.

“If you looked at the money that the Ethics Commission is spending going after citizen filers and reallocated it toward a staff of clerks, the cost to the city would be minimal,” Lynn said, estimating it at about $100,000.

Calling it the “H&R Block Unit,” Lynn thinks a staff of 10 to 15 clerks could be trained to assist small campaigns, individuals, and first-time filers who would come in and be walked through the complex paperwork.

St. Croix said such services are available now to inexperienced treasurers and those who ask for help — although not nearly as extensive as Lynn envisions — and he’d like to expand them in the future. But he said there are legal and practical complications to giving campaigns formal advice in letters that they might later use in their defense.

“I think it’s a lofty goal to educate people,” commission chair Susan Harriman told us. “We have staff with the sole job to keep people educated.” She said she’s attended meetings at which outreach occurred between the commission and community, but only as an observer. She thinks it’s the job of the staff to take an active community role, although St. Croix said that’s a resource issue.

Commissioner Emi Gusukuma thinks the appointed commissioners should be more involved. “I would be happy to be part of that team,” she said of joining any Ethics community outreach. “Going to clubs — I would definitely be willing to do that.” She noted that she and her fellow commissioners are all very busy, but she still thinks the educational aspect of their role is important.

Hansen also noted that a commission filled with relatively new appointees needs to hear more about the real-world impacts of its policies. “The public can educate the commissioners, and right now the commissioners are not educated on these issues,” Hansen said.

She and other reformers would like to see St. Croix facilitate a discussion of what the commission’s enforcement history has been and where the focus should be going forward.

“The perception is all we ever do is go after the small guys, but I don’t know if that’s really true,” Gusukuma said. She’s pushing staff to do more research into past enforcement actions “so we can tell the staff … not who to prosecute but what kinds of cases are important. We haven’t been able to get that analysis yet.”

Lynn said another key component in the education campaign would be to televise Ethics Commission hearings, which would help people become more engaged with the agency’s work. Commissioners Hansen and Gusukuma agreed, endorsing the proposal in this year’s budget cycle and winning the support of Sup. Chris Daly before he was ousted as chair of the Budget and Finance Committee, after which the expenditure (estimated at about $30,000 per year) was removed from the budget.

Harriman is opposed to televising hearings and thinks the money should be spent elsewhere. “I don’t think it’s a good idea. I think interested people who are interested in items on the agenda will appear. I think it’s a waste of city funds to televise something.”

Lynn said that attitude is the problem.

“The Ethics Commission doesn’t want to be televised, which is the reason to televise them,” he said. “They don’t want it because they’re trained that they are quasi-judicial and you don’t have cameras in courtrooms. Right now Ethics is invisible. The only way it can build a constituency is if it’s visible.”

Bob Planthold, another former commissioner, agreed. “Ethics doesn’t make friends,” he said. “It doesn’t have a constituency of positive advocates, and you need that at City Hall to get money and resources.”<\!s>*

 

A half-century of lies

Leola King has lived your life, the lives of three friends and then some.

She’s traveled to Africa with the legendary entertainer, Josephine Baker. She’s featured jazz great Louis Armstrong at a popular Fillmore nightclub she helmed in the 1950s called the Blue Mirror, where she also once convinced a roomful of patrons to drink sweet champagne from the heel of her shoe.

She’s played host to the crusading television journalist Edward R. Murrow.

She’s even had a fling with championship boxer Joe Louis. From the ring at Madison Square Garden, he glanced toward her front-row seat, which she’d secured by chance during her first trip to New York, and had his lackeys retrieve her for a date afterward. Their rendezvous appeared as a gossip item in an Ohio paper and remains in its archives today.

Most of all, Leola King has come as close as anyone possibly can to experiencing bureaucratic hell on earth. For half a century, she’s been fighting with the San Francisco Redevelopment Agency, which has taken four pieces of her property, wiped out a restaurant and two nightclubs she owned, and left her with a string of broken promises.

Her story is evidence that the ugly local chapter of Western Addition redevelopment history still isn’t over – and it’s a demonstration of why so many African Americans in this town will never trust the Redevelopment Agency.

Beginning in the 1940s, King successfully operated a series of restaurants and nightclubs in the city, remarkable enough in an era that imposed a double-paned glass ceiling on black, female entrepreneurs.

“Back when I first moved onto Fillmore, it was very popular,” King told the Guardian. “Market Street didn’t have shit. They didn’t have traffic. They didn’t have nothing on Market Street.”

During the height of King’s accomplishments, the Redevelopment Agency infamously launched an ambitious project to clear out “blight” in the neighborhood. It was part of a nationwide urban-renewal trend, and while the project here still won’t be finished until 2009, it’s widely regarded as one of America’s worst urban-planning disasters.

In theory, Western Addition residents who were forced to give up their homes or businesses were given a “certificate of preference,” a promise that when the sometimes decaying buildings were turned to kindling and new ones built, the former occupants could return.

In practice, it didn’t work out that way. An estimated 5,500 certificates were issued to families and business owners shortly before the second phase of Western Addition redevelopment began in 1964. Some 5,000 families were dislodged and many of them fled to other sectors of the city (including Bayview-Hunter’s Point, which is today slated for its own redevelopment), or outside of the Bay Area completely.

Only a fraction of the certificates have benefited anyone. The agency has lost contact information for more than half of the holders, and redevelopment commissioners now openly admit the program is a joke.

“If we’re going to boast about being this diverse community in San Francisco, and we’re going to allow our African American population to become extinct, then how can we show our faces in government if we’re not really doing anything about it?” asked London Breed, a redevelopment commissioner appointed by Gavin Newsom in 2005. “And not just putting black people in low-income housing. There [are] a lot of middle-class African Americans all across America, specifically in the East Bay and in other places. Why do they choose to live in the East Bay over San Francisco?”

A renewed interest in the certificates by City Hall led to hearings this month, and District 5 Sup. Ross Mirkarimi has planned another for April.

King obtained two certificates, and attempts to later redeem them both devolved into costly legal wrangling with the agency that lasted more than two decades. She has never regained what she lost.

Leola King’s story is about more than certificates of preference. It’s a story about the troubling legacy of urban renewal.

King welcomes guests into her home on Eddy Street near Fillmore with ease. The living room in what is little more than a two-bedroom converted garage apartment swells unimaginably with antiques – three stuffed chairs with vinyl slips, crystal chandeliers, an ornate dining-room table, lamps, a fur throw.

She insists that she’s just 39 years old, but public records put her closer to 84.

When the Guardian first visited with her in person, she was dressed in black cotton leisure attire. Two chestnut braids cascaded from a gray Kangol-style cap, which she smoothed with her hands as they hugged a pair of light-skinned cherub cheeks.

King made her way west after spending her earliest years behind the barbed wire of a Cherokee reservation in Haskell, Ok. Her mother died when King was young, and her restless father had meandered off to Los Angeles. Her grandparents oversaw her adolescence before she trailed after her father to California, where he was establishing a chain of barbecue restaurants. She married a man at just 14, and a year later, she was a mother. Tony Tyler, her son, is a San Francisco tour guide today and remains a close confidant and business partner.

It was 1946 when she first landed in San Francisco and eventually started her own barbecue pit at 1601 Geary St., near Buchanan, historic building inspection records show. She called it Oklahoma King’s, and hungry San Franciscans were lured to the smell of exotic buffalo, deer and quail meats.

“That end of Fillmore was very popular all the way down until you got almost to Pacific [Avenue],” she said. “Heavily populated. There was at one time in that area of Fillmore over 100 bars alone. Lots of hamburger places. That’s where I had the barbecue pit.”

By 1949, however, Congress had made urban renewal federal law with the goal of leveling slums and deleting general “blight,” still the most popular and awkwardly defined threshold for determining where the government can clear homes and businesses using eminent domain.

The first redevelopment zone in the Western Addition, known as A-1, included Oklahoma King’s. She was paid approximately $25,000 for the property, but offered no relocation assistance or other compensation for the revenue she lost as a result of ceasing her day-to-day business.

Forging ahead, she opened in 1953 what became a hub of jazz and blues entertainment in the Fillmore, the Blue Mirror, at 935 Fillmore Street. The place was decorated with brass Greek figurines on the walls, a circular bar and velvet festoons. King spent a year hopping onto buses full of tourists and begging the driver to drop them by her nightclub for a drink. Before long, her brassy personality had attracted world-class performers, each of them adding electricity to the club’s reputation.

“She was the type of woman who knew how to handle people,” a Blue Mirror regular later said in the 2006 collection of Fillmore jazz-era photography, Harlem of the West. “She could talk to the pimps and hustlers. She didn’t play around, and they knew how to conduct themselves in her club.”

A musician who formerly worked there told the Guardian the Blue Mirror was one of the few places on Fillmore that actually provided live entertainment at that time. Bobbie Webb backed up B.B. King, Little Willie John, T-Bone Walker and others as a young saxophonist at the Blue Mirror with his band the Rhythm Rockers. He said the other establishments nearby on Fillmore were mostly bars except for headlining auditoriums where mainstream acts like James Brown and the Temptations performed. Smaller venues abounded up the street on Divisadero, he said, save mostly for King’s Blue Mirror and the Booker T. Washington Hotel.

“[King] didn’t only have a personality” said Webb, who now airs a show Tuesdays on 89.5 KPOO, “she was a beautiful lady. Personality just spoke for itself. All she had to do was stand there.”

But like virtually everyone in the neighborhood at that time, King rented the place where the Blue Mirror operated. Redevelopment again reached her business in the early 1960s. State booze enforcers, she says, claimed to have witnessed a bartender serving alcohol to a minor and her liquor license was taken away. When the Redevelopment Agency showed up shortly thereafter to sweep the block away, she was ejected without compensation because she wasn’t at that time technically in business.

Two more commercial and residential properties she owned on Post and Webster streets respectively were also eventually taken under redevelopment.

She pressed on, encouraged by Jewish business owners in the area she’d befriended, including liquor wholesaler Max Sobel and Fairmont Hotel operator Benjamin Swig.

“Whenever I’d lose something, they’d say, ‘Keep on moving. Don’t stop, because you’ll lose your customers. When you open back up, they won’t know who you are.’ They’re the ones who told me, ‘Go get another spot.'”

By the time King began work on her third business in the Fillmore, urban renewal projects had wreaked havoc on minority communities across the nation, including neighborhoods in west-side Boston, downtown Atlanta, the celebrated 18th & Vine District of Kansas City and elsewhere.

King opened the Bird Cage Tavern at 1505 Fillmore St. in 1964 near O’Farrell complete with a jukebox, 30-foot mahogany bar, a piano and a gilded birdcage. Then-police chief Thomas J. Cahill tried to block her liquor-license renewal by complaining to the state about “winos” and “prostitutes” in the neighborhood, records show, but regulators dismissed the claims.

“We had viable businesses all around us,” King said. “I had one fellow I worked with a lot named Willie Jones. He was a blues singer. The interesting thing was, I had music in the daytime at the Bird Cage. I specialized in afternoon jazz.”

Despite a triumphant resettlement, nonetheless, the redevelopment agency arrived yet again and bought her building during the expansion of it’s A-2 redevelopment phase and served as landlord for the Bird Cage, a barber shop and a liquor store as it waited for another two years deciding what to do with the building.

On the agency’s watch, a fire broke out next door to the Bird Cage that led to water damage in her space. Federal Housing and Urban Development records show that no insurance claim was ever filed by the Redevelopment Agency. King says the agency removed some of the bar’s contents, mostly kitchen supplies, and made only stopgap repairs to the building anticipating that she would later be ousted anyway. The items they took, she says, were never returned.

The agency then evicted all of the building’s tenants in 1974. This time, King stood fast and had to be forced out by the sheriff. The agency promised relocation assistance, but those empty assurances became her biggest headache yet. In fact, she would spend the next 25 years quarreling with the agency over relocation terms.

King and the agency searched fruitlessly until 1977 for a suitable replacement building before King purchased her own out of desperation at 1081 Post St. She was then forced to begin another endurance test of working to actually extract money from the agency owed to her for properly outfitting the new building.

Meanwhile, the Bird Cage’s leftover furnishings – from oil paintings, rugs and curtains to an ice maker, wood shelving and an antique porcelain lamp – were destroyed when the agency amazingly chose to store them on an outdoor lot off Third Street during her move, a fact later confirmed by an agency employee in an affidavit.

“They moved it all out,” King said, “all these antiques and stuff, into this field where the weather ate it up.”

The agency’s initial response was to determine how it could best avoid legal liability. Redevelopment officials finally offered her about $100,000, which she needed desperately to keep things moving with the Bird Cage’s new location, but King insists today the materials were worth closer to $1 million.

As she was fighting to reopen her bar business, she attempted to redeem an earlier certificate of preference given to her when she’d lost a residential property on Webster Street to redevelopment. In 1983, she bought a condemned, 12-unit apartment building on Eddy Street hoping to rehabilitate it using a federally backed loan.

The deal only led to more trouble. The agency paid for its own roving security to patrol Western Addition properties it had purchased, and before 1431 Eddy St. was ever officially conveyed to King (as well as two other neighboring developers), thieves gutted the building of windows, doors, plumbing, light fixtures and other hardware. (Two buildings belonging to neighboring developers were also hit, and the agency addressed their losses the same way.)

Almost immediately, the agency told her she’d purchased the building “as is” and that they weren’t responsible for the break-in. But according to an internal 1983 memo marked “confidential,” later unearthed when friends of King submitted a records request to the agency, staffers clearly were concerned about the legal implications of offering one building for sale “as is” and actually providing another one on the date of delivery that had been thoroughly burglarized.

The memo shows that the possibility of a lawsuit was of greater concern to the agency than any obligation to compensate King for the lost hardware, regardless of whether proper security was the agency’s responsibility. Records show they did discuss a settlement of little more than $2,000, but King considered the stolen goods to be worth thousands of dollars more.

She managed to eventually finish the rehabilitation of her Eddy Street property after several years of work, and while she lives there today, time and angst took their toll. Each step of the transition to what she hoped would someday become her new bar, Goldie’s on Post Street, involved a seemingly endless round of yet more negotiations, letters, legal threats and bureaucratic backbiting before the agency would lift a finger and allocate money for contractors, necessary seismic upgrades, architects and equipment.

In 1997, then-Rep. Ron Dellums (now Oakland mayor) wrote a letter to top local HUD official Art Agnos (later a San Francisco mayor) on King’s behalf.

“On August 26, Ms. King met with a member of my staff and detailed issues surrounding a 25-year dispute she has attempted to resolve with HUD and the San Francisco Redevelopment Agency,” Dellums wrote. “Your expeditious attention to this matter is [a] request, as Ms. King is elderly and experiencing health problems. The resolution to this issue would allow her to live the remainder of her life with some piece of mind.”

It was too late. The federally backed loans she’d received from HUD to rehab her Eddy Street property, from which the Redevelopment Agency strictly enforced repayment, fell into default. Loans leveraged against her other remaining properties began to slip, too, all while she fought with the forces of redevelopment to recreate what she had once proudly possessed.

King’s story may seem like an unfathomable streak of bad luck, but there’s a paper trail for all of it. And her battle, laid out in hundreds of pages of documents saved by King over several decades and reviewed by the Guardian, was ultimately unsuccessful..

By 1997, King was submerged in bankruptcy proceedings and would lose pretty much everything that she owned, including an Edwardian landmark home on Scott Street near Alamo Square where she’d lived for years (partially burned in a 1986 fire, believe it or not) and a residential building on Sutter Street.

Goldie’s was to be her final resting place, a roost from which she hoped to feature cabaret dancing, fresh crab at happy hour, a refined art deco aesthetic and live music performances. She lost that, too. Today, it’s Diva’s just off Polk Street.

Urban renewal won.

Hopeful press accounts lately foretell a jazz revival in the Fillmore District fueled by enterprising developers deft at financing lucrative redevelopment projects through tax incentives and low-interest loans half a century after the promise of “renewal,” now described euphemistically as “historic preservation.”

But with such a sordid history behind them, it’s no wonder residents of Bayview-Hunter’s Point, many of whom escaped Western Addition “renewal” in the first place, are leery of a pending years-long plan to redevelop nearly 1,500 acres in the southeast neighborhoods.

Bayview newspaper publisher Willie Ratcliff led a petition drive last year in an effort to put the plan before voters. Over 20,000 petition signatures were certified by elections officials, but City Attorney Dennis Herrera ruled the petitions were technically invalid because circulators hadn’t presented the full text of the redevelopment plan to signers. Redevelopment foes have since sued to have Herrera’s decision tossed.

“The misuse by these people is just unbelievable,” King said. “They were fighting me every inch.”

It’s funny: the transcontinental railroad was born in San Francisco, and it transformed California. But the West Coast has pretty much lost the train thing. You want to go from here to Los Angeles, there are pretty much two choices: you can fly or you can drive. In theory, you can ride Amtrak, and I’ve done it, but it doesn’t run very often and takes about 12 hours. Fun, if you like that sort of thing, but not at all practical.

But on an early Sunday morning last week, I was traveling from Washington, DC, to Philadelphia, and between 8 a.m. and noon there were about half a dozen trains running on that route. The high-speed Acela got me to Philly in 90 minutes, downtown to downtown, way faster than I could drive. Another hour or so, and I could have been in Manhattan.

There are flights from Washington, DC, to New York, but these days it seems kind of silly to fly: by the time you arrive at the airport, get through security, go up, go down, deplane, and get from the airport to the city, you’re well beyond three hours. The train’s way cheaper too.

Yeah, I love trains (actual legroom, no seat belt signs, scenery, bar cars), so I’m biased, but it seems silly that California is spending billions of dollars on highway projects (including a new bore for the Caldecott Tunnel, a colossal waste if there ever were one), and we still aren’t talking seriously about high-speed rail to Los Angeles, which would probably bring more environmental and economic benefits than all of the other transportation projects in the state put together.

There are plenty of reasons to wring your hands over Assemblymember Mark Leno’s decision to challenge incumbent state senator Carole Migden in 2008. The race will almost certainly be bitter and ugly; both sides have an incentive to go negative. It could split the queer community, leave progressives wondering whom to support, and turn political allies into enemies.

Or maybe it won’t: I wonder if San Francisco’s progressive community is mature enough today to handle this without any bad long-term impacts. Some of the city’s left leaders will back Leno, and some will back Migden, but in the end, neither one of these candidates is the enemy, and if everyone keeps a sense of perspective (the way we were able to do in the District 5 race in 2004), it doesn’t have to be a bloodbath.

I realize that Leno is running in part because of term limits, which might not be the most noble of motivations. And I’m against term limits. But there’s actually a reason to be happy about this race: it’s a demonstration that old-style machine politics is dead in San Francisco.

Ten years ago this race would never have happened. Willie Brown was in charge — really in charge — and no local Democrat would have dared to defy his will. Brown didn’t like contested races between Democrats, and he would have told one of the two candidates to back off, and that would have been that.

We live in a different political world now. Mayor Gavin Newsom will probably support Leno, but he has way too much on his mind right now to be involved in any kind of backroom deal. Neither Migden nor Leno has the kind of clout to scare the other away, and nobody else in this town does either.

Democracy isn’t always pretty, but after living under the machine for a couple of decades, I find this almost refreshing. *

A real war on crime

OPINION Once again, with their backs against the wall, Republicans are attempting to stave off political defeat in November by playing to Americans’ fears about safety and security. Central to the conservative playbook for years has been the lie that progressives cannot keep our communities safe.
The reality is that the current, shortsighted approach to public safety, which touts punishment without rehabilitation, has been a failure. One of the starkest examples is the crisis in California’s prison and parole system — and every day that crisis comes home to San Francisco. Thousands of people are being released from behind bars with no plans and few skills or opportunities. More than 1,500 parolees are living in San Francisco at any given time, and thousands more are being released from county jail every year. Of the estimated 125,000 California prisoners who will be released this year, three out of four will end up back in prison by 2009. California has the highest recidivism rate in the country.
Behind every rearrest is a new crime, often with a new victim. Taxpayers also foot the bill — to the tune of more than $34,000 a year for each person who ends up back in prison.
It’s time for a change. We can no longer accept the fact that three out of four former prisoners will be back behind bars within three years. In this progressive city, we are committed to working together to break that cycle of recidivism by channeling former prisoners into productive lives. These programs must target the crucial process of what’s called “reentry,” the release of individuals from state prison or county jails back into their families and neighborhoods.
Two weeks ago, more than 200 reentry experts and service providers, along with government and criminal justice agencies, gathered for the city’s first-ever Reentry Summit. This past year, Supervisor Ross Mirkarimi sponsored a $1.2 million budget allocation to support new reentry programs. We’ve also spearheaded the San Francisco Reentry Coordinating Council, bringing together members from the business sector, labor, key city agencies, the clergy, and community organizations.
Members of the council have pioneered concrete reentry programs that are delivering results. District Attorney Kamala Harris has created a new accountability and workforce reentry initiative for drug offenders called Back on Track. Public Defender Jeff Adachi’s Clean Slate program provides community-education services and programs to clear criminal records to nearly 2,500 people a year. Sheriff Mike Hennessey is poised to open the Women’s Reentry Center, which will provide direct practical support services to women coming out of jail and prison.
While the city is more than doing its part at a local level to address this issue, we cannot do it alone. It is time for the state to own up to its responsibility for rehabilitating parolees and probationers and ensuring their successful return home. With a detailed, sustained, statewide reentry effort, we can guide former prisoners away from crime, reduce corrections costs, and keep our neighborhoods safe. SFBG

District 6 sleaze

EDITORIAL The fall campaign season has only begun, and already the District 6 race is getting really ugly. A downtown-funded operation, hiding behind anonymous mailers and front groups, is spending gobs of money to smear Sup. Chris Daly, and thanks to the city’s campaign-spending laws, Daly’s ability to fight back is limited. The whole mess points to a real problem in the way so-called independent-expenditure committees are regulated, and the supervisors and the Ethics Commission should take up the issue immediately.
Daly, who’s represented the district for almost six years, has offended a lot of people — including some of the city’s richest and most powerful interest groups. They tried to unseat him four years ago with no success, but this time around they have more money and a slimy, secretive strategy that appears to expose a loophole in local law.
The first salvo landed a few weeks ago: a slick, 22-page mailer called “The Case Against Chris Daly” that attacks him on almost every front. The hit piece is unsigned, so the people who received it have no way of knowing exactly who’s behind the message. And there’s no requirement that the sponsors register with the city’s Ethics Commission and reveal their source of financing.
It’s pretty clear, though, who produced and paid for the piece. The money is going through a group called Citizens for Reform Leadership #1, which was set up by downtown elections lawyer Jim Sutton, organized by SFSOS, and funded in large part by Republican kingmaker and the Gap founder Don Fisher. (Sutton has also established Citizens for Reform Leadership committees two through six, indicating that there’s more of this to come.)
The way San Francisco’s campaign-spending limits work, no candidate for supervisor can spend more than $83,000 — unless one of the other candidates breaks that cap. Then all rules are off. But that cap doesn’t apply to whoever put out the 22-page hit piece — in part because we don’t even know legally who it was. That means the SFSOS-Fisher crew can spend hundreds of thousands of dollars hammering away at Daly — and he can’t spend more than $83,000 fighting back.
The candidate who benefits most from this sewer money is Rob Black, a former aide to Sup. Michela Alioto-Pier who has the backing of Mayor Gavin Newsom and is by any account Daly’s most serious challenger. Black told us he has no direct connection to the hit squad — but he stopped short of promising not to engage in negative campaigning himself. And he’s certainly not going around town denouncing the anti-Daly sleaze.
That should change now. If Black wants to be seen as anything other than a pawn of Fisher, he should put out a formal statement calling on SFSOS and its allies to back off, quit the anonymous name-calling, and either come clean or stay out of District 6. So should every other candidate in the race. (The hotly contested District 5 battle two years ago was remarkably clean, in part because all of the candidates agreed not to accept this sort of nonsense.)
The Ethics Commission should launch a full investigation of this anonymous campaigning with the aim of exposing the forces behind it — and if the city’s current law doesn’t allow a ban on secret hit pieces, the supervisors should amend it today. Meanwhile, the commission ought to lift the expenditure limit for District 6; it’s not optimal, but in this case it’s only fair. SFBG

Cops out of their cars

EDITORIAL The politics of crime can be tricky for the left: progressives are against far-reaching and punitive crackdowns, against police abuse, against the pervasive financial waste in law enforcement … and sometimes can’t come up with answers when neighborhoods like Hunters Point and the Western Addition ask what local government is going to do to stop waves of violence like the homicide epidemic plaguing San Francisco today.
So it’s encouraging to see Sup. Ross Mirkarimi, a Green Party member representing District 5, taking the lead on demanding more beat cops for the highest-crime areas in town. Mirkarimi’s not pushing a traditional reactionary approach of suggesting that the city hire more police officers and lock more people in jail; he’s advocating a simple — and decidedly progressive — approach to the issue. He wants the cops out of their cars and on the streets. On foot.
The idea of beat cops and community policing isn’t new at all; in fact, it’s the modern approach of highly mobile officers in cars, dispatched by a central computer and radio system in response to emergency calls, that’s a relatively recent trend. Police brass love it — they can cover more ground with fewer troops — and a lot of patrol officers like it too. They have that big metal car to protect them from potentially hostile criminals, and they don’t have to interact every minute of every day with the people on the streets.
But cops walking the beat are a proven deterrent to crime — and that’s not merely because of their visible presence. Properly trained and motivated community police officers can forge ties with merchants, residents, and neighborhood leaders. They can figure out where problems are likely to happen. They can become an asset to the community — not an outside occupying force that residents neither trust nor respect.
It’s a crucial change: right now, one of the biggest problems the San Francisco Police Department faces in solving homicides is the unwillingness of witnesses to come forward, in part because of a general mistrust of police. When there’s a killing, homicide detectives appear as if out of nowhere, demanding answers; it’s little wonder nobody wants to talk to them.
We recognize that beat patrols won’t solve the homicide crisis by themselves. That’s a complex socioeconomic issue with roots in poverty and desperation, and a couple of folks in blue on the street corner can’t alleviate decades of political and economic neglect.
And we also realize that it can be expensive to put officers on foot — they can’t respond as fast, and it takes time to develop community ties. But Mirkarimi isn’t asking for a total overhaul of the SFPD’s operations. He’s asking for a modest pilot program, a one-year experiment that would put two foot patrols a day in the Western Addition, focusing on areas with the most violent crime. The ultimate goal, Mirkarimi says, is to create a citywide beat-patrol program.
It won’t be easy: the department seems to be pulling out all the stops to defeat Mirkarimi’s proposal, which will come before the Board of Supervisors on Sept. 19. The Police Commission needs to come out in support of Mirkarimi’s proposal and direct Chief Heather Fong and her senior staff to work to make it effective.
The supervisors, some of whom worry that beat patrols in high-crime districts will mean less police presence in other areas, should give this very limited program a chance. Nothing else is working. SFBG

After oil

OPINION Every day a river of cars flows across the Bay Bridge into San Francisco, bringing workers, tourists, and visitors to the city. Nearly all run on petroleum fuels. Every day a staccato procession of planes lands at SFO, bringing tourists, conventioneers, and returning residents. All fly on petroleum fuels. Every day a phalanx of trucks delivers food to grocery stores, restaurants, and corner markets. All run on petroleum fuels. Every day roads are paved, potholes are filled, roofs are tarred, machinery is lubricated, and tires are replaced. All are done with petroleum-derived products. Every day hundreds of thousands of purchases take place, every one enabled by petroleum.
What will happen when the petroleum behind all these activities costs $100 a barrel? $200 a barrel? Or more? San Francisco’s viability as a major West Coast city is based on cheap petroleum. But the century of cheap petroleum is quickly coming to an end, and an era of expensive, scarce oil is dawning. Just as US production of oil peaked in 1970, production of oil from an increasing number of other countries has peaked as well. Currently, 33 of the top 48 major oil producers in the world are in irreversible decline, among them the United Kingdom, Norway, Mexico, and Indonesia. Within a few years — and indeed some claim it has already happened — global oil production will peak, then begin a protracted decline. The consequences are unthinkable. A world — and a city — built on cheap petroleum faces the largest challenge of modern times.
Nothing exists that can seamlessly replace petroleum. For transport, ethanol and biodiesel have been touted but both require tremendously higher levels of energy inputs for production compared to petroleum, and the competition with food production is already apparent with the rising price of corn in the Midwest. For other uses — lubrication, paving, plastics, pesticides, pharmaceuticals, cosmetics, paints, inks, solvents, detergents, rubber, and thousands more — no drop-in substitute is remotely ready. Alternate sources — such as the tar sands of Canada — produce in net only a half barrel of oil for every barrel of energy consumed. As petroleum production reaches its peak, every aspect of our lives will be profoundly impacted.
What can be done? First, it’s important to understand the phenomenon. Peak oil is not an oil company conspiracy, nor is it the result of OPEC’s actions — this is the result of a century and a half of ever-rising exploitation of a finite energy source. Second, we need to examine how we use energy in San Francisco to determine ways to either reduce consumption or find nonfossil alternatives to supply it. We need to examine our food supply — completely dependent on petroleum for planting, harvesting, processing, and transporting — along with city operations and residential, commercial, and transportation requirements to assess their vulnerability in an era of rising energy prices.
In April, San Francisco became the first major city in the United States to pass a peak-oil resolution, and on July 28 the San Francisco Local Agency Formation Commission held the first in a series of hearings on the issue of peak oil. Over the next year the commission will hold additional public hearings to educate and inform the citizenry of San Francisco on peak oil and will be launching a study to identify the possible responses we can take. Bicycle projects in San Francisco — from the ambitious Blue Greenway initiative to new bike lanes to the simple shared-lane arrows, or “sharrows,” that have been painted on some roadways — have been shut down by a preliminary injunction that Judge James Warren signed as one of his final actions before retiring.
The ruling is part of a lawsuit brought by Rob Anderson, a 63-year-old dishwasher, blogger (whose District 5 Diary regularly blasts the “bike nuts” and “anticar activists”), and failed District 5 supervisorial candidate. Anderson and two groups he formed — Ninety-Nine Percent (referring to those who he believes don’t ride bicycles) and Coalition for Adequate Review — last year sued the city over its Bicycle Plan, arguing that it should have received more rigorous environmental review under the California Environmental Quality Act (CEQA).
Unless the injunction is overturned, city officials are prohibited from making any physical changes contemplated by the plan until completion of a trial that’s set to begin Sept. 13. The Bicycle Plan, which California cities must update every five years to qualify for certain public funds, was unanimously approved by the Board of Supervisors and signed by the mayor last year.
City officials and bicycle advocates were shocked by the scope of Warren’s ruling. “This is big. It’s means nothing new for bikes for probably the next year,” said Andy Thornley, program director for the San Francisco Bicycle Coalition. “It’s pretty strict, even worse than we feared.”
Beyond the prohibition of “installing bicycle lanes on any street in San Francisco named or described in any part of the plan and its maps” and a range of other physical changes, the ruling says the city can’t pursue plans to allow more bikes on public transit. Anderson and attorney Mary Miles didn’t get everything they wanted, such as an end to the city’s “educational or training programs, enforcement activities, or promotional activities,” but that was small consolation to city officials.
“We’re disappointed with the injunction and we disagree with Judge Warren’s conclusions,” said Matt Dorsey, spokesperson for the City Attorney’s Office. Dorsey said the lawsuit and injunction defy the spirit of CEQA, as well as its specific exemptions for bike lanes on public streets. “Bikes are already allowed the use of all the streets in San Francisco.”
But Anderson said the Bike Plan should have been subjected to a full-blown environmental impact report before being approved, rather than a finding of exemption from such review, as the board ruled.
“This is not about the contents of the plan itself. It is about the process,” Anderson told the Guardian.
But Anderson’s arguments go well beyond process and bureaucratic details — instead they are driven by what appears to be deep animosity toward the bicycle community, which he has expressed on his blog and in public comments during city meetings.
“I think cycling in the city is dangerous and foolish,” Anderson told us. “It’s irresponsible for the city to encourage an inherently dangerous activity.”
Despite that danger Anderson said he doesn’t believe the city should be building bike lanes or pursuing other safety measures because only a very small percentage of city residents will ever ride bikes. He said that bicyclists are nothing but “an elitist special interest.”
Anderson refused to identify who’s helping to fund his suit or other members of his organization, except to say it’s a “small group” that mostly drives cars. (Anderson said he relies mostly on public transit and walking.) Although he said he believes in global warming and decries traffic congestion, he doesn’t believe bikes are a reasonable form of alternative transportation.
“It’s a progressive fantasy. Bicycles are not the answer to any problem. This is America, not Amsterdam. There are big cars and lots of them,” Anderson told us.
Yet city officials remain uniformly committed to promoting bicycling.
On June 23, Mayor Gavin Newsom issued a public statement saying, in part, “Despite Judge Warren’s preliminary injunction, I remain committed to making San Francisco a national leader for bicycle transportation. Our goal is to increase the number of bike trips in the city to reach 10 percent of all trips by 2010. My administration will do everything within our power to reach that goal.” SFBG

Save John Swett!

OPINION In seeking to close the John Swett Alternative Elementary School in San Francisco’s Western Addition, the San Francisco Unified School District is making a gargantuan mistake.

We knew from the start of the evaluation process that John Swett didn’t come close to qualifying for closure or merger. By the board’s own criteria, Swett shouldn’t have been a candidate. Yet it remained, inexplicably, on the closure list.

Only now, through our own research and public records requests we made to the school district, has the rationale for the school’s closure become clear: It’s not an educational decision made in the best interests of students. It’s a property decision made in the best interests of administrators. Situated just two blocks from the SFUSD’s headquarters at 555 Franklin St., John Swett has apparently struck some administrators as an attractive target for expanding administrative offices.

Long before the unhappy coincidence of its proximity to SFUSD headquarters potentially doomed its existence, John Swett was rapidly becoming a poster child for public schools in working-class minority communities. It offers the only arts program of its kind in the district and has provided opportunities for cultural enrichment to a population to whom far too many opportunities are routinely denied. Its enrollment of 240 students was quickly approaching the facility’s full 280-student capacity, with a population reflecting the rich, diverse mosaic of San Francisco: 43 percent African American, 31 percent Pacific Islander, 14 percent Latino, and the remainder an integrated mix of whites, Asians, and others. And more curiously, if the issue at Swett was really about enrollment, the district could have looked across the street to reconcile any shortfall: Tenderloin Community School’s population is at 120 percent.

Sup. Chris Daly and I have worked hard to galvanize as much support as possible within City Hall to make the school board’s decision to save the school for students an easy one. We secured passage of an ordinance to provide $660,000 from city funds to gain John Swett a reprieve.

For neighborhoods like the Western Addition and Tenderloin, plagued by the interrelated problems of joblessness, drugs, truancy, and gun violence, the decision seems utterly counterproductive. What good are violence-prevention strategies when they are subverted by actions like shutting down John Swett School?

This battle is about setting the right priorities. It’s time to put the students first. The plain fact is that kids from minority working-class communities need good schools that are already intact more than school bureaucrats need adjacent facilities for themselves or a half-baked plan for something else. An innocent school has been unjustly condemned. Its execution is set to go. There are moments until midnight. Can we save it? SFBG
