The great escape

There are some dark clouds hovering over City College of San Francisco. The District Attorney’s Office is investigating political corruption allegations, a long-awaited audit of half a billion dollars in bond spending is just months from completion, and several infrastructure projects are running tens of millions of dollars over budget.

But Chancellor Phil Day won’t be around to clean up those messes. He’s leaving City College for a new job on the East Coast at the National Association of Student Financial Aid Administrators as early as March 1.

Day’s announcement came just weeks before the school’s Board of Trustees Jan. 10 unveiling of the results of an internal investigation into who knew what about City College money from taxpayers being diverted to an election campaign committee that should have operated entirely independently of the school.

The investigation concludes that there was no evidence that contractors made donations to a campaign committee formed by the school’s leadership in exchange for favorable business arrangements.

But the report does confirm that two lower-level bureaucrats, Stephen Herman and James Blomquist, instructed business tenants who used school facilities — the coffer vendor Bean Scene and Bay Area Motorcycle Training — to sign rent checks over to the committee instead of to the school. Neither tenant appeared to have any intention of contributing to the committee.

The timing of the checks is also questionable. The school returned the Bean Scene’s $20,000 rent check shortly after recognizing a potential violation of the state’s Education Code, which prohibits using school funds for electioneering purposes. But officials then violated the same provision when a $10,000 rent check from the motorcycle-training outfit wasn’t returned to public coffers until a year and a half later, when the San Francisco Chronicle‘s Lance Williams began snooping around.

"The fact that an apparent misuse of public funds could be discovered, corrected, and then occur again after such a short period reveals a glaring lack of oversight of the College’s involvement in fundraising from College contractors, literally from start to finish during the campaign," the report states.

City College’s trustees and school administrators created the Committee to Support Our City College in 2005 as a campaign vehicle for convincing voters to authorize $246 million in bond projects, the third such bond election for City College in a decade.

The report’s executive summary in part downplays the significance of the Chron stories from last April that inspired the probe in the first place. Rather, it implies that the fund diversions had more to do with a poor accounting system and an 11th-hour decision to rush the bond election to voters with minimum preparation.

It’s not clear how the report will impact a DA’s investigation of the campaign committee related to the same allegations. The Guardian revealed last summer (see "Day’s Dilemma," 8/8/07) that just days before the November 2005 election, Kamala Harris’s office also requested documents stemming from the college’s $8.7 million purchase of land in Chinatown that the county determined was worth only $1.7 million for tax purposes.

We also reported that City College’s half a billion dollars in infrastructure improvements are running approximately $225 million over budget and as a result, the school has gutted projects promised to voters and reallocated about $130 million in order to sustain others (see "The City College Shell Game," 7/4/07). An expansive management audit of the school’s bond spending is due in June.

In a prepared statement, Day insists the fund diversions were an accident, and he complains that if the San Francisco Ethics Commission had notified it of the mistake sooner, the school would have corrected it. The Guardian reported that the Ethics Commission had known the Bay Area Motorcycle Training check was illegally used by the committee but waited for more than a year to notify the state’s Fair Political Practices Commission of a possible elections law violation (see "At the Crossroads," 7/18/07).

"As the chancellor and CEO of this college, I take responsibility for these mistakes," Day’s statement reads. "However, it is important to understand that these mistakes occurred innocently and inadvertently, and as soon as we learned of them, we took immediate action to rectify them."

An exasperated Day, who became City College’s chancellor in 1998, said in a phone interview that he didn’t believe the school’s troubles would make it difficult for his successor to return to the ballot and get voters to approve bond projects they’ve already partially paid for, including a stem-cell technology training center.

"I don’t feel like I’m leaving someone with disarray," Day told us. "It’s the people in the institution that sometimes make mistakes, not the institution itself."

Day’s departure also comes as a building inspector hired by the school in 2003 alleges in a federal lawsuit that he was wrongfully terminated last summer for blowing the whistle on illegal building code violations and for making safety complaints during facility renovations. The suit was filed Dec. 24, 2007.

Plaintiff Lawrence Lauser contends that he’d repeatedly informed his bosses at City College that building codes were being violated during construction work, but there was no willingness to fix them.

Instead of being outright fired, Lauser alleges, he was told the work had run out. "That was a complete sham," his attorney, Frank Sarro, said. "There wasn’t a lack of work at all." Lauser is also suing his union, the United Brotherhood of Carpenters and Joiners Local 22, for refusing to request arbitration with the school on his behalf.

"He just had a strong feeling that things should be done by the book," Sarro said of Lauser. "And his bosses didn’t want to hear it."

Remember those stories from Lance Williams at the Chronicle that surfaced awhile back about City College of San Francisco improperly diverting public funds to a campaign committee? The school’s Board of Trustees promptly called for an internal probe, and all 232 pages of it are now publicly available. The executive summary downplays the significance of the allegations and lauds the school’s administration for fully cooperating with the investigation:

“The proponents of California ballot measures tend to seek contributions from those who stand to benefit financially from the passage of the measure. This can lead to the criticism that such fundraising has the appearance of “pay to play.” One need only conduct a cursory review of each campaign statement … filed by the Committee to Support Our City College to find numerous engineering firms, building trades and other construction businesses who could benefit from the proceeds of the bond.

City College chancellor steps down; Christmas ruined for thousands

How can the people of San Francisco make it through the holiday season without crying uncontrollably over the just-announced departure of San Francisco City College Chancellor Phil Day? In a statement, Day apologized profusely for destroying your Christmas.

“I am truly sorry that I must deliver this message on the eve of our traditional holiday break but I did not want you to find out about this by reading the papers or having it via news reports.”

Thank you for being so kind, Chancellor. Clearly the media frenzy resulting from your official announcement to step down is making it difficult for San Franciscans to concentrate on their celebrations — including the public and private critics of your administration, many of whom worked hard to help us understand just how much of a mess the school’s costly bond projects are in.

Green City: Solar solutions

GREEN CITY When Berkeley mayor Tom Bates recently announced a creative city plan to financially assist homeowners who want to dress their roofs in solar panels, people across the Bay wondered if San Francisco could come up with something similar.

It’s happening. Sup. Gerardo Sandoval is working with the City Attorney’s Office on legislation to make solar panels more affordable for property owners. "The idea with my proposal is the city would use its very high credit rating to borrow money at almost zero cost," the District 11 supervisor said. That money would be turned over to citizens as low-interest loans to be paid back through a monthly assessment, similar to a property tax, with a very low interest rate. "It’s going to be a lot cheaper than what homeowners can do on their own."

A photovoltaic array for a typical home can cost the owner as much as $40,000, though state and federal incentives can reduce the cost by about $10,000. Systems are typically guaranteed by the manufacturers for 20 to 25 years, and the cost is recouped over time in reduced energy bills.

But the initial investment is high enough to discourage many would-be solar users. "The main challenge for many homeowners is the substantial upfront cost. It could easily cost you up to $50,000 to upgrade your home," Sandoval said of the bill for items like insulation, solar panels, and wind generators that can help modify a building to use less energy more efficiently.

Under this new financial program, the entire city would be declared a tax assessment district — similar to a Mello-Roos, or community benefit, district — with a resident opting in by deciding to buy solar panels. Both Berkeley and San Francisco are charter cities, which gives them the ability to tweak state laws, like the one that permits the creation of Mello-Roos districts, to meet local needs.

The plan to help private property owners has a number of public benefits. By generating most of their power on their roofs, homeowners will draw less juice from the grid, which is heavily dependent on fossil fuels (and is ultimately inefficient, as much energy is lost through transmission from distant power plants).

San Francisco is fast closing in on its 2012 deadline to reduce greenhouse gas emissions to 1990 levels, and a July Civil Grand Jury report found the city would have to triple its current reduction rate to meet that goal. Sandoval’s plan would help. According to a federal study, one kilowatt of solar electricity offsets about 217,000 pounds of carbon dioxide emissions per year. Additionally, the city is aiming to provide 31 megawatts of solar power capacity through Community Choice Aggregation, which Sandoval sees as part of his plan.

"Both programs are about organizing our city to get off the grid and get off fossil fuels," he said, adding that he hopes this financing model will expand to all renewable-energy and efficiency upgrades to homes and businesses.

The plan is still in its nascent stages, and a few administrative and legal questions remain.

It’s unclear which city department would administer the program, although San Francisco Public Utilities Commission spokesperson Tony Winnicker said, "We already have a framework to administer something like this," citing the management infrastructure of the city’s water and sewer systems. The Department of the Environment has also been suggested. Sandoval said, "There are a lot of different city agencies who see benefits of administering the program." He was clear that it should remain in the public sector, with the possible assistance of community-based nonprofits that understand the local needs of their neighborhoods.

Sandoval also sees his proposed program as a way to foster the right kind of industry in San Francisco. The volume of solar business could bring more manufacturing companies, and City College of San Francisco and other educational programs could partner with manufacturers to train consultants and installers.

Barry Cinnamon, CEO of Akeena Solar, a Los Gatos PV installer, expressed enthusiasm and support for the plan. "It’s really commendable that cities like San Francisco and Berkeley are trying to find ways to do this."

Sandoval hopes to see the program up and running within a year, and said, "If no one accuses me of conflict of interest, I’ll be among the first to sign up."

A theocratic democracy?

My old friend Reese Erlich is remarkably optimistic about Iran, which is a pleasant perspective. I’m glad somebody is.
In his insightful, if sometimes choppy, new book, The Iran Agenda: The Real Story of U.S. Policy and the Middle East Crisis, he offers an alternative view of a nation and a culture that has been either ignored or demonized by the mainstream press for more than 30 years. His basic thesis — that US policy toward Tehran is moronic, driven by foolish politics, bad information, and greedy geopolitical aims — is hard to dispute. His subtext — that there’s real hope for democracy in Iran — is a bit of a tougher sell.
Erlich has done what few US journalists ever do: he’s visited Iran, repeatedly, and taken the time to meet not just with government officials and activists but with ordinary Iranians. Almost across the board, they condemn the United States and support the Islamic state.
We’re presented with “liberal” politicians — which might be a bit of a stretch — and radical activists, including Marxists, who offer a vision of a democratic Iran. Me, I’m dubious about any hope for theocratic democracy; as a proud atheist, I think that separation of church and state — strict, inviolable separation — is essential for any functioning democracy.
But Erlich’s willing to give other cultures and ways of thinking a break, which is one of the main reasons he’s such a good reporter. And in The Iran Agenda he presents a picture of a nation far more complex than the caricatures we’ve seen depicted by the administration and the evening news.
That’s the real value of this book: you get a sense from a veteran journalist of what you’ve been missing all these years. Erlich tries to sort out the ethnic geopolitics of Iran and explain which groups are aligned with whom (and why the United States supports some of them). It’s all somewhat dizzying, but that’s part of the point. This situation is more complicated than most American opinion makers are willing to admit.
And for all that, it’s a good read.

"We’d like to be pro — in the sense that we’d like to not work and have lots of money," Aaron Sunshine says of the Passionistas. Based on the group’s Kelley Stoltz–produced debut, God’s Boat (New and Used Records), Sunshine, fellow songwriter Myles Cooper, and bandmate Andrew Lux have earned the right to think big. Yeah, it’s hard to draw blood from a stone, but it’s even tougher to mine new blood from old rock music. Yet that’s exactly what the Passionistas do. If you’re a 21st-century modern lover, ready for post-Y2K "12XU" anthems, and you know you can’t hide your love forever, your dream soundtrack is ready. The Passionistas are so new and so classic they could revirginize an ancient whore.

They’ve got the punk smarts to cover Yoko Ono’s conflicted "No No No," to know fucking is a hot word not used often enough in rock lyrics, and to realize that it’s impossible for a song named "Teenage Jesus" to be lame. But make no mistake: the Passionistas have huge pop potential. They love Lil’ Wayne (Cooper: "He really frees himself of history to say what he feels"), they think Beyoncé’s aggressive shrillness is a sign of the times (Sunshine: "B-Day is like a hardcore album"), and they worship Aaliyah (Sunshine: "She and R. Kelly and Timbaland had this crazy alternative vision that is what we now think of as R&B"). Tom Sneddon is their antichrist. "We supported Michael Jackson through his entire trial," says Sunshine, a young man with a mission born and raised in the Mission. "We have a drum that has ‘Free the King of Pop’ painted on it."

The agnostic-to-atheist Cooper and Sunshine met in a math class at City College of San Francisco. They took the title God’s Boat from a speech by a contestant on Missy Elliott’s reality show The Road to Stardom. If their road to stardom is flooded, they’re ready to go the Noah’s ark route, or perhaps catch a ride on the American whales — seal-bullying orcas sporting stars and stripes — that are part of the Bay Area vista on their album’s Photoshopped back cover. Never descending into what Cooper disdainfully calls a "brofest," the Passionistas’ studio recording with longtime fan Stoltz is ready for the canon. "One Foot on a Banana Peel" is the best grandma-dis track ever, "Fucking Cold" is a boy-raised-on-riot-grrrl tantrum that makes the absolute most of leaping an octave, and if Lou Reed hadn’t turned into such a bore, he’d undoubtedly wish that he’d written "Going Gay." Day’s dilemma

One investigation by the District Attorney’s Office is enough of a headache for City College of San Francisco. But two?

The Guardian learned that just days before the November 2005 election, in which City College asked voters for $246.3 million in bond money to continue a series of capital works projects, the office of Vice Chancellor Peter Goldstein received a letter from investigators requesting detailed information about a land transaction that took place in Chinatown earlier that year.

At least three of the school’s elected trustees don’t recall being informed by Chancellor Phil Day about the probe, setting off new concerns after we alerted officials about the letter, which the Guardian obtained. The DA’s Office is also investigating potential laundering of public funds into campaign donations by college officials in connection with that bond campaign.

"It puts a further cloud on the college," trustee Julio Ramos told us. "Presumably the statute of limitations has not run on the transaction, so what’s going on here? I’m concerned because no one ever informed us."

Two other trustees, Milton Marks and board president Anita Grier, told us they don’t remember being told of the inquest.

"We do have to give them some leeway to operate the college without informing us of everything," Marks said. "But when the district attorney is asking questions about something that’s coming from a board action, why wouldn’t we have to know about it as early as possible? It’s kind of indefensible."

But Day fervently insisted that the board was informed of the letter during a closed-session meeting the same month the letter was received and that Ramos and Marks simply weren’t there. Day had no explanation for why Grier couldn’t recall it, but trustees Rodel Rodis, Natalie Berg, and Lawrence Wong and former trustee Johnnie Carter all confirmed they’d been told about it. Day also said the school had never heard back from the DA’s office after it produced all of the requested documents.

"I had even forgot about the fact that we had this initial inquiry back then," Day told us. "I had totally removed it from my brain and forgotten about it completely."

Either way, this is the first the public has heard of the DA’s interest in City College’s land deals. Debbie Mesloh, a spokesperson for District Attorney Kamala Harris, told us she could neither confirm nor deny that any such investigation was taking place, although the letter confirms that an investigation was opened.

The DA this year began an inquiry into City College after the San Francisco Chronicle revealed that the school had used a $10,000 lease payment from a business tenant to help bankroll a campaign committee formed for the purpose of promoting the 2005 bond election, City College’s third since 1997.

But we now know that the DA began snooping around the college’s land purchases in October 2005, when Goldstein was asked for escrow documents, property appraisals, memos, and board minutes concerning the school’s purchase of two lots in Chinatown at the corner of Kearny and Washington streets for a long-planned (and now vastly over budget) campus.

The Guardian has also obtained a pile of documents detailing months of real estate negotiations between the college and politically connected Chinatown businessman Pius Lee, who owned one of the lots and had an option to buy a neighboring and much larger tract.

The construction of the new Chinatown–<\d>North Beach campus hasn’t gone smoothly for the college or voters. The school originally used $5.8 million to buy property in the neighborhood using bond money that voters authorized in 1997. Voters were then asked for $45 million in 2001 to build the campus, with construction expected to begin in 2003.

But Day’s ambitions led to clashes with Chinatown residents after the original plan — slated for an area facing Columbus Avenue on the other side of the block from where City College now hopes to build — called for demolishing a historic building and low-income apartments housing elderly tenants.

The school entered a legal settlement promising to preserve the Columbo Building and relocate the nearby Fong Building’s tenants. In 2005, however, it hastily decided incorporating that work would be "infeasible" and turned to Lee for help in finding a new location.

Lee (who did not return our calls) told the college he’d give up a sliver of land he owned on the other side of the block and also help it secure the much larger lot nearby owned by a Taiwanese company, Fantec Development Corp., with which Lee had a long business relationship.

The school paid Lee $1.9 million for a strip of parking lot 18 feet wide, even though an appraisal that City College received placed its market value at $1.1 million, records show. (San Francisco County assessed it at $267,000 in 2004 for tax purposes. The neighboring, much larger piece of land, also a parking lot, was assessed at $1.5 million.) During early negotiations, records show, the college offered $785,000 for Lee’s property and $4.5 million for Fantec’s, but in the end it wound up paying much more — a total of $8.7 million in bond money for both.

Yet it’s not clear precisely what investigators were looking into, what they found, or whether the investigation is still open.

"The properties were not available for anything less than the price we paid for them," Goldstein told us. "That’s what the sellers demanded in order to sell their properties…. Pius drove a very hard deal and demanded what I would consider to be the maximum possible price for his property that we could defend."

Ground still hasn’t been broken on the school’s Chinatown dream, and in the interim, as we’ve reported recently, the estimated costs have ballooned from $75 million to $122 million, an increase of 62 percent. As a result, the school has chosen to gut some projects authorized by voters to keep this and other favored proposals alive (see "The City College Shell Game," 7/4/07).

The Board of Trustees is slated to vote next month on whether to certify the campus’s environmental documents and whether the project should be exempt from building height limits in the neighborhood.<\!s>*

San Francisco Ethics Commission executive director John St. Croix has admitted that his office knew in 2005 about the alleged laundering of public money into a San Francisco City College bond election campaign — well before the story broke in newspapers in April — but did nothing to investigate.

That startling revelation knits together two concurrent series that the Guardian has been running for the past two weeks: one on City College’s deceptive and unaccountable use of bond money and another on the uneasiness local watchdogs feel about the Ethics Commission’s ability and willingness to mete out balanced punishment to elections-law violators.

When news reports surfaced in April that City College allegedly had diverted up to $30,000 in public money to a bond election campaign committee, Chancellor Phil Day moved quickly to limit the fallout. So did independently elected trustee Rodel Rodis, who along with six other board members is responsible for controlling and managing the San Francisco Community College District.

During meetings organized that month to address the matter, Day came clean and blamed everything on a "relatively new" assistant vice chancellor. At least two trustees, one of whom had been recently elected, still wanted to know more about why it was allowed to happen. Rodis, on the other hand, complained that hiring an independent investigator at a cost of $75,000 to look into the matter was too expensive and framed the stories — written by San Francisco Chronicle investigate reporter Lance Williams — as an unfair attack on the college.

"Let’s be mindful that we’re still in a budget crisis and we still need to watch taxpayer money," Rodis said at one of the meetings.

Unlike Rodis, District Attorney Kamala Harris didn’t treat the allegations as insignificant and is now reportedly probing possible criminal violations in connection with the scandal. The investigation, Williams wrote recently, includes contributions made to the committee by contractors that did recent business with the school.

But where was the Ethics Commission during all of this? The controversy raises serious questions about why the agency never took any action against City College when, as its mission statement declares, its responsibility is to "actively enforce all ethics laws and rules, including campaign finance and open government laws."

Late in the commission’s July 9 meeting, St. Croix made the stunning admission that although his office knew about the allegations surrounding City College’s dubious handling of public funds all the way back in 2005, for some inexplicable reason it did nothing.

Staff shortages and poor financing have plagued the Ethics Commission since voters created it in 1993. Although the number of staffers has doubled during his three-year tenure, St. Croix nonetheless told the Guardian recently that his agency remains dependent on the public to help expose political candidates and campaign committees that break the law.

"We still rely on people and the city being watchdogs," St. Croix told us. "We’re supposed to be the eyes and ears for a lot of things, but we’re still extremely limited."

In this case, however, St. Croix’s office was well aware of allegations that City College bureaucrats had misappropriated public funds. The school’s Board of Trustees, along with Day’s office, created the Committee to Support Our City College in 2005 to convince voters to give the school $246.3 million in bond money to continue with a slate of capital works projects that began in 1997 and now are costing hundreds of millions of dollars more than anticipated.

The owner of a motorcycle training school claimed in a December 2005 letter to the Ethics Commission that he was told by the college to make a rent check for the regular use of school property payable to the committee instead of the school itself. Amazingly, the Ethics Commission pondered contacting the state’s Fair Political Practices Commission to disclose the allegations, which is the least it should have done, but never actually did so, as St. Croix has acknowledged only now.

"I take responsibility for that," St. Croix told us. "I don’t know who actually dropped the ball. But at the time we had less staff and there were a lot of things we were supposed to do and we weren’t doing."

Nor did the Ethics Commission contact the college to demand that it amend its campaign filings from that year to reflect the true source of that $10,000 payment and acknowledge itself rather than the motorcycle training school as a major contributor to the bond committee. St. Croix figured that could happen at the conclusion of the FPPC’s inquiry. Of course, the FPPC didn’t know about the allegations, at least not until the Ethics Commission finally contacted it in May, following the Chronicle‘s front-page stories.

The Ethics Commission’s lax approach to City College oversight also extends to trustees like Rodis, who has his own apparent campaign finance violations from his 2004 reelection campaign. That year, records show, his campaign failed to turn in three key election filings required to ensure that before heading to the ballot box, voters have a chance to see where candidates are getting their campaign money from. The commission sent his campaign several warning letters; just one of the filings finally arrived nine months later.

The trustee pointed to a campaign staffer when we contacted him regarding the tardy campaign statements. "We had someone working on the campaign who was supposed to do that," Rodis told us. "He indicated to us that everything was in order. We relied on him. We paid him. And then we found out later that he didn’t do what he was supposed to do…. It was one of those things that happen when you trust people."

The filing Rodis did manage to turn in shows that of the more than $44,000 he raised for his reelection effort that year, at least $1,700 had no identified donors, and other donations were marred by confusing data entry errors. An internal Ethics memo obtained by the Guardian that discusses the Rodis reelection campaign committee concludes that its poor reporting "appears to be a matter of willfulness and disregard for the law" and what belated filings do exist "present significant data problems." According to the memo, "Based on the record, significant questions remain regarding the true facts of the committee’s financing."

Rodis in 2004 won reelection to the board for the fourth time since he first became a trustee in 1991. According to our conservative estimates based only on the late filings, he could be liable for thousands of dollars in fines. *

The San Francisco Ethics Commission is at an important crossroads, facing decisions that could have a profound impact on the city’s political culture: should every violation be treated equally or should this agency focus on the most flagrant efforts to corrupt the political system?

The traditionally anemic agency that regulates campaign spending is just now starting to get the staff and resources it needs to fulfill its mandate. But its aggressive investigation of grassroots treasurer Carolyn Knee (see “The Ethics of Ethics,” 7/4/07) — which concluded July 9 with her being fined just $267 — is raising questions about its focus and mission.

“For the first time in our history, we’re having growing pains,” Ethics Commission executive director John St. Croix told the Guardian, noting that the agency’s 16 staffers (slated to increase to 19 next year) are double what he started with three years ago.

Reformers like Joe Lynn — a former Ethics staffer and later a commissioner — say the commission should do more to help small, all-volunteer campaigns negotiate the Byzantine campaign finance rules, be more forgiving when such campaigns make mistakes, and focus on more significant violations by campaigns that seek to deceive voters and swing elections.

“The traditional thinking is there’s no exception to the law, and that’s been my traditional thinking too,” Lynn said. “But it doesn’t cut the mustard when you see a Carolyn Knee say, ‘I’m not going to do that again.'<\!s>”

At Knee’s June 11 hearing, Doug Comstock — who often does political consulting for small organizations — urged commissioners to reevaluate their mission. “Why are you here?” he asked them. “You’re not here to pick on the little guys.”

Yet St. Croix told us, “That’s not really the way the law is written. Everybody is supposed to be treated the same…. The notion that the Ethics Commission was only created to nail the big guns is not correct.”

That said, St. Croix agrees that regulators should be tougher on willful violators and those who have lots of experience and familiarity with the rules they’re breaking. And he said they do that. But it’s the grassroots campaigns that tend to have the most violations.

“It’s frustrating because the people who make the most mistakes are the ones with the least experience,” St. Croix said, noting that the commission can’t simply ignore violations.

 

A MATTER OF PRIORITIES

But critics of the commission say the problem is one of priorities. Even if there were problems with Knee’s campaign, there was no reason the commission should have launched such an in-depth and expensive investigation four years after the fact. That decision was recently criticized in a resolution approved by the San Francisco Democratic County Central Committee, which argued that the approach discourages citizens from getting politically involved.

“[The] San Francisco Ethics Commission spends an inordinate amount of its meager resources in pursuing petty violations allegedly committed by grassroots campaigns; this disproportionate enforcement against grassroots campaigns is directly contrary to the goal of the Campaign Finance Reform Ordinance,” one “whereas” from the resolution read.

The resolution’s principal sponsor, Robert Haaland, is intimately familiar with the problem. When he ran for supervisor in District 5 two years ago, his treasurer had a doctorate from Stanford and still struggled to understand and comply with the law. But they made a good-faith effort, he said, and shouldn’t be targeted by Ethics.

“It’s sort of like the IRS going after the little guy,” Haaland told us. “The commissioners need to set the direction of the commission for where they’re spending their time and resources.”

Eileen Hansen is perhaps the only member of the five-person commission to really embrace the idea that its mission is to help citizen activists comply with the law and to go after well-funded professionals who seek to skirt it. To do otherwise is to harm San Francisco’s unique grassroots political system.

“It’s true, the law is the law,” Hansen told us. “But I do think the Ethics Commission needs to grapple with how to apply the law in a fair manner.”

Is it fair to apply the same standard to Knee and to the treasurer of the campaign on the other side of the public power measure she was pushing, veteran campaign attorney Jim Sutton, whose failure to report late contributions from Pacific Gas and Electric Co. later triggered a $240,000 fine by Ethics and the California Fair Political Practices Commission, while those contributions might have tipped the outcome of the election?

Sutton gets hired by most of the big-money campaigns in town, such as Mayor Gavin Newsom’s, and has a history of skirting the law, including a recent case of allegedly laundered public funds at City College; coordination of deceptive independent expenditures against Supervisors Chris Daly, Gerardo Sandoval, and Jake McGoldrick; District Attorney Kamala Harris’s violation of her spending-cap pledge in 2003; and an apparent attempt to launder inaugural-committee funds to pay Newsom’s outstanding campaign debts (see “Newsom’s Funny Money,” 2/11/04). Yet the practice of the commission is to ignore that history and treat Sutton, who did not return calls seeking comment, the same as everyone else.

“We all admire and want grassroots organizations to do what they need to do,” Commissioner Emi Gusukuma said. But, she said, “the laws are there for a reason…. We’re supposed to enforce and interpret the law. The law should only apply to big money? The law has to apply to everybody. We can’t pick or choose.”

David Looman, a campaign consultant and treasurer involved in dozens of past elections, put it wryly. “Some people talk as though the grassroots campaigns shouldn’t have to obey the law,” he said of some activists he’s worked for who consider themselves the good guys. He said he reminds them, “This is the act that you helped pass, and now you gotta abide by it.”

“But there ought to be some kind of business sense here. Most regulatory agencies have offenses which they regard as de minimis,” Looman said, meaning “you get a nasty letter that says, ‘Don’t make a habit of it,’ and when you do make a habit of it, stricter penalties come into play.”

His experience with the commission has led him to believe there’s no sense of priorities when it comes to what Ethics pursues. Many of the small campaign committees Looman represents have been audited to what he feels is a ridiculous extent.

In one case, he told us, he took over the management of the Bernal Heights Democratic Club and discovered that it hadn’t been filing certain documents for years. He ended up paying $10,000 out of his own pocket to cover Ethics fines just because his name was now on the dotted line.

“Yes, the Bernal Heights Democratic Club was in complete violation of the law. They deserved to pay a penalty, but it was so far out of proportion. It was two times our yearly income. I think that’s inappropriate,” Looman told us.

 

THE GRASSROOTS CULTURE

Some say the whole idea of local campaign reform is to nurture an important and unique aspect of San Francisco: its vibrant and diverse grassroots political culture. “For every two committees in LA, there are three in San Francisco,” Lynn said, adding that it used to be a more extreme, two-to-one ratio. Larger cities often have more professionals involved, he said. “San Francisco has a unique political culture, very heavy on the grass roots.”

Yet the Ethics Commission doesn’t see protection of the little person as part of its mission.

“The fundamental problem with Ethics is it is not staffed by people who have been advocates for good government reforms,” Lynn said. “The Ethics Commission needs to come to grips with the fact that they’re tampering with the grassroots political culture of San Francisco.”

Lynn would like the commission to direct some resources toward hiring assistants to staff the office during the two or three weeks prior to Election Day, a crew that would help prevent violations and inoculate campaigns against being fined for errors that do occur.

“If you looked at the money that the Ethics Commission is spending going after citizen filers and reallocated it toward a staff of clerks, the cost to the city would be minimal,” Lynn said, estimating it at about $100,000.

Calling it the “H&R Block Unit,” Lynn thinks a staff of 10 to 15 clerks could be trained to assist small campaigns, individuals, and first-time filers who would come in and be walked through the complex paperwork.

St. Croix said such services are available now to inexperienced treasurers and those who ask for help — although not nearly as extensive as Lynn envisions — and he’d like to expand them in the future. But he said there are legal and practical complications to giving campaigns formal advice in letters that they might later use in their defense.

“I think it’s a lofty goal to educate people,” commission chair Susan Harriman told us. “We have staff with the sole job to keep people educated.” She said she’s attended meetings at which outreach occurred between the commission and community, but only as an observer. She thinks it’s the job of the staff to take an active community role, although St. Croix said that’s a resource issue.

Commissioner Emi Gusukuma thinks the appointed commissioners should be more involved. “I would be happy to be part of that team,” she said of joining any Ethics community outreach. “Going to clubs — I would definitely be willing to do that.” She noted that she and her fellow commissioners are all very busy, but she still thinks the educational aspect of their role is important.

Hansen also noted that a commission filled with relatively new appointees needs to hear more about the real-world impacts of its policies. “The public can educate the commissioners, and right now the commissioners are not educated on these issues,” Hansen said.

She and other reformers would like to see St. Croix facilitate a discussion of what the commission’s enforcement history has been and where the focus should be going forward.

“The perception is all we ever do is go after the small guys, but I don’t know if that’s really true,” Gusukuma said. She’s pushing staff to do more research into past enforcement actions “so we can tell the staff … not who to prosecute but what kinds of cases are important. We haven’t been able to get that analysis yet.”

Lynn said another key component in the education campaign would be to televise Ethics Commission hearings, which would help people become more engaged with the agency’s work. Commissioners Hansen and Gusukuma agreed, endorsing the proposal in this year’s budget cycle and winning the support of Sup. Chris Daly before he was ousted as chair of the Budget and Finance Committee, after which the expenditure (estimated at about $30,000 per year) was removed from the budget.

Harriman is opposed to televising hearings and thinks the money should be spent elsewhere. “I don’t think it’s a good idea. I think interested people who are interested in items on the agenda will appear. I think it’s a waste of city funds to televise something.”

Lynn said that attitude is the problem.

“The Ethics Commission doesn’t want to be televised, which is the reason to televise them,” he said. “They don’t want it because they’re trained that they are quasi-judicial and you don’t have cameras in courtrooms. Right now Ethics is invisible. The only way it can build a constituency is if it’s visible.”

Bob Planthold, another former commissioner, agreed. “Ethics doesn’t make friends,” he said. “It doesn’t have a constituency of positive advocates, and you need that at City Hall to get money and resources.”<\!s>*

 

The City College loophole

EDITORIAL The 2000 law that made it easier for schools and college districts to sell bonds for capital improvements requires every agency raising money this way to create a citizens’ oversight committee to monitor spending. It also mandates regular audits.

But it’s a bit unclear what the audit requirement actually means — and as G.W. Schulz reports on page 15, that’s allowed some outfits, including San Francisco’s Community College District, to get away with spending hundreds of millions of dollars without proper accountability.

Some lawyers argue that school districts need only undergo perfunctory financial audits. Others say the law mandates detailed performance audits. This sounds like a minor point, but it’s not: financial audits only look at what was spent. Performance audits look at how and why — and whether the money was spent in accordance with what the voters were promised.

The City College administration is only now, reluctantly, agreeing to a performance audit, something that should have been done five years ago. The school’s lawyers say bond money can be freely shuffled from project to project, at any time, and there’s no need for regular performance audits.

There’s a simple way to clear this up: Attorney General Jerry Brown needs to issue an opinion on the intent of the law. And if he won’t do that or comes down on the side of unaccountable government, then the state Legislature needs to pass a bill mandating performance audits and requiring that bond proceeds actually go where the voters were told they would.

David Duer is proud of the volunteer work he’s done with the West Contra Costa Unified School District. He graduated from the area’s school system, as did his kids.

So despite what was sure to be a burdensome responsibility with no pay, Duer, a development director for the UC Berkeley Library, accepted the chance to serve on a committee formed under a state mandate to monitor how the district spent $850 million in bond money authorized by voters in three elections since 2000.

"There are schools all over the district that have been renovated," Duer beams today.

The committee initially proposed meeting every quarter but soon realized that wouldn’t be nearly enough to do the job right and chose to meet monthly instead. Since 2003 it has received full-blown management audits of the school system’s performance every year, with biannual updates from independent professionals not beholden to district bureaucrats.

The story of San Francisco’s Community College District could not be more different.

The oversight committee that’s charged with monitoring $560 million in bond spending has never seen an expansive performance audit, just basic financial reports that show community college officials here seem to be obeying their most fundamental fiduciary duties. The panel meets three times a year for more than an hour and a half each time, and for three years it didn’t even report to the public on City College’s handling of the money, which it’s required to do annually by the state’s Education Code.

The community college committee is hardly made of Rotary volunteers and bored retirees: the list includes San Francisco treasurer José Cisneros and former San Francisco Chronicle publisher Steve Falk, now head of the local Chamber of Commerce.

But even members say the panel has fallen down on the job — and that City College officials are freely shifting around the taxpayers’ cash with little or no accountability.

The mostly decipherable performance reports that West Contra Costa citizens receive, though lengthy, track all of that district’s bond expenditures and give the area’s oversight committee of taxpayers a vivid portrait of how well the school system and its administrators are managing hundreds of millions of dollars in building improvements. Any wonkish jargon in the reports that might mystify the committee is translated in "frank" terms by the outside inspectors, Duer says, without interference from school officials.

If a contractor were to double-bill the district or demand too much in change orders after promising completion within a set price range, Duer and his colleagues would know about it, and they could make suggestions on how to fix it. If the district was doing a stellar job, that would be clear too.

"I don’t see these performance audits as punitive," Duer said. "I see them as a confirmation that the process and systems in place are working."

MORE MONEY PROBLEMS


The Guardian reported last week ("The City College Shell Game," 7/4/07) that City College’s bond projects are running an astounding $225 million over budget. As a result, school officials have returned to the Board of Trustees five times in recent years to request that a total of $130 million be reallocated from one project to another to cover the overruns, leaving some projects promised to voters with little or no funding at all. We reported on a number of examples last week, but there are plenty more:

<\!s> The construction of a new Mission campus was supposed to begin in 2002 but didn’t get under way until well into 2005. The project is now $30 million over budget, an increase of 50 percent, and the school recently requested another $6 million diversion from other bond projects. City College originally planned to build the campus where a shuttered theater currently stands on Mission Street but later moved the site to avoid a showdown with preservationists.

<\!s> Since 1997, City College has asked voters for a total of $61 million to renovate and remodel existing buildings and meet Americans with Disabilities Act requirements. In November 2005 it asked voters for $35 million to perform such work, but just weeks after the election, $20 million of the money was reallocated to a planned Chinatown–<\d>North Beach campus that’s now running $50 million over budget, an increase of 60 percent. That project’s ever-changing design has been heatedly challenged by everyone from the Chronicle‘s editorial board to Sup. Aaron Peskin to state senator Leland Yee.

<\!s> Two projects for which voters authorized a combined $71 million won’t see the light of day unless the college returns to the ballot a fourth time, which school officials have discussed. The projects — a biotech learning center and a one-stop administrative shop for new students — have been drained of $42 million to save the Mission campus and an overdue Performing Arts Center, which will cost $75 million more than expected, an increase of 152 percent.

HUNTING AND PECKING


All of this irks Mara Kopp, who was appointed to City College’s oversight committee in late 2005 as a representative of the San Francisco Taxpayers Association. She’s complained openly that the school long ago should have hired auditors for the kind of far-reaching work West Contra Costa gets.

"If we received ongoing management reports, then we’d have something of substance," Kopp said. "We wouldn’t have to hunt and peck in a kind of naive, elementary way."

She is all but alone in her criticism, however, save for a small group of allies including former committee member John Rizzo and Milton Marks, one of the few voices on the independently elected Board of Trustees willing to apply tough scrutiny to Chancellor Phil Day’s office at board meetings. Green Party pol Rizzo recently became a trustee after closely beating longtime incumbent Johnnie Carter in the November 2006 board race.

Day has long argued that the school’s attorneys don’t believe such audits are required under Proposition 39, a 2000 state ballot measure that lowered the threshold for passing local school bonds. Prop. 39 required the formation of local citizens’ bond oversight committees.

Marks has questioned the strength of City College’s oversight committee and the lack of performance audits since at least 2005, but not until earlier this year were he and Rizzo able to force a resolution demanding the inspections, and now Day claims to welcome a management review. The school will bid out its first audit soon.

"The bottom line is, a performance audit as opposed to a financial audit would determine whether or not funds are being expended in the most efficient, effective, and economical manner instead of just adding up these funds and saying, ‘Here’s how much we expended and for what,’<\!s>" said Harvey Rose, a respected local auditor who’s reviewed city agencies and analyzed San Francisco’s annual budget for 35 years.

West Contra Costa concluded that Prop. 39 does require extensive managements audits. The committee even decided to include a $150 million bond election in 2000 in the scope of its work, although that wasn’t required, to ensure all the money was still being spent efficiently.

Duer said it doesn’t matter to him what the letter of the law requires. "It was always assumed with our work that this is something we had to have," he said.

The Los Angeles Community College District made the same assumption. Other districts statewide, however, appear to have interpreted Prop. 39 the same way City College has. And the Attorney General’s Office has never issued an opinion clarifying the matter.

Meanwhile, City College officials blame the millions of dollars in outsize project costs on inflation, a globally increased demand for steel and concrete, and slow-moving state regulators who must approve architectural designs.

"I understand both the college as well as the community would like to see us complete every single project we’ve proposed," Vice Chancellor Peter Goldstein told us recently. "We absolutely share that desire. The reality of cost increases has forced us to go back and look at our resources and reallocate in order to keep major projects going forward."

But Kopp and company argue that much earlier performance inspections would have revealed to the oversight committee and trustees where the increase in expenses came from with absolute certainty. That way, no one would have to rely exclusively on the glitzy project presentations made by Day and Goldstein that are often little more than slide shows with quotes from prominent business journals decrying the rising cost of construction materials. Trustee Marks has moaned repeatedly at board meetings that he doesn’t feel informed enough to vote on major reallocations, and his constant questions haven’t always made him popular.

"I think there’s this feeling that the board should not be adversarial," Marks said. "But I think by the nature of how things are set up, we have to be…. We have to look out for the best interests of the public at large."

Not everything’s rosy in West Contra Costa, of course. Anton Jungherr, a former San Francisco Unified School District official, sat on the West Contra Costa oversight committee for four years and fumed in an interview that the district didn’t take seriously the committee’s regular recommendations. He wants to form a statewide association of oversight committees to arm citizens with the information they need to track bond expenditures.

"There are legitimate reasons for change orders, but you have to analyze them and understand what the reasons are and then take the appropriate oversight action," Jungherr said.

But cost overruns in West Contra Costa still pale when compared with those at City College. Jungherr said that district has experienced about $100 million in unexpected costs on $850 million in projects undertaken since 2000, substantially less than what City College faces despite hundreds of millions of dollars more in bond projects.

Kopp still hopes City College’s oversight committee will build more muscle.

"If they were to show us documents they used themselves in monitoring all these things, that could substitute as long as the information was relevant and honest," Kopp said. "But it’s really been quite shallow all along."<\!s>*

City College’s funny money

EDITORIAL There’s an excuse for every dollar of bond money that the San Francisco Community College District board has misspent in the past 10 years: The cost of construction materials has gone up (thanks to Hurricane Katrina and the rapid industrialization of China). State grants weren’t what the administration expected. One staffer did a bad job with price estimating. The list goes on and on.

But in the end, the truth remains: City College officials have lied to the voters. They’ve taken $130 million in bond money that was supposed to go to one set of projects and moved it to other projects. And they’ve gone $225 million over budget on three bond acts — so they’re preparing to come back to the voters for a fourth infusion of cash.

And all of this has happened without the performance audit that state law requires for community college bonds.

As G.W. Schulz reports on page 15, City College administrators say they never intended to shift the bond money around like tokens in a three-card monte game. It’s just that some projects weren’t ready and some needed more money and some changed in priority — and of course, according to the district’s lawyers, it was all perfectly legal. Maybe so — but it’s awfully fishy and even at best is a serious violation of public trust.

When the voters approve a bond act to pay for, say, a new performing arts center at City College, there’s an implicit assumption that the taxpayer money they agree to spend will actually be used for what they were told. That may not always be exactly possible; once a big institution starts on a half-billion-dollar spending program, a few things won’t turn out the way they were supposed to. That’s why the law allows a little wiggle room. But in the end, overall, most of the money ought to go for what the voters were promised.

And in ballot arguments and presentations to the community over the years, the City College administration and the board have offered a very explicit set of proposals. We’ve seen all those presentations; never once has Chancellor Philip Day or one of the board members told us that the voters would be writing in effect a blank check — that the specific projects listed on the bond act might or might not be completed, or that the money might be shifted somewhere else at the whim of the board at some later date.

That, sadly, is exactly what’s happened — on a massive scale. More than 25 percent of the bond money has been "reallocated" — earmarked for one project, then spent on another. The most obvious and most controversial has been the gym (which City College likes to call a "wellness center"). As we first reported Sept. 22, 2004 (see "Field of Schemes"), the trustees shifted $53 million that we’d been promised would be spent on an arts center and other projects to the gym, which includes a pool so expensive to operate that it’s going to be leased out in the afternoons to a private school across the street.

The wellness center may be a perfectly worthy project (the pool nonsense aside), but it’s not what the voters were told they were approving. And it’s hardly the only example. In one case, Schulz reports, the City College staff clearly knew before election day that the information in the ballot handbook was inaccurate and the money would be spent in different ways than what the voters were promised.

State law requires that public agencies conduct performance audits of these large bond projects — but that’s never been done at City College. Only now, with the District Attorney’s Office crawling all over campus and criminal charges possible, has the board finally approved an audit.

Meanwhile, the college board still hasn’t adopted the San Francisco Sunshine Ordinance — which isn’t surprising, since all of this has the feel of a series of backroom deals. Even some trustees, like Milton Marks III, who don’t outright oppose the reallocations say the money was moved without the board getting proper information from the administration.

City College is too important an institution to have its future (and the needs of the students and faculty) jeopardized by these kinds of political games. The board’s performance audit needs to move forward apace — and the trustees ought to hire someone like Harvey Rose to do a full financial audit of where the money’s gone, why the budget is so badly busted, and what can be done to clean it up.

If the district attorney is investigating possible wrongdoing in some of the campaigns, she might have her staff look into the bond reallocations too. And if indeed this is all legal, then the state Legislature needs to change the law and require that institutions using bond money pay at least a modicum of attention to what the voters were promised when it comes time to start writing checks. *

The motto of San Francisco’s community college is "The truth will set you free."

For taxpayers, that’s a painful irony. Since 1997, the district has moved around $130 million in bond money in a fiscal shell game, taking funds that the voters were told would go to one set of projects and spending the money on others.

The half-billion-dollar bond program is now at least $225 million over budget, in part because of what the school admits was shoddy planning, and City College is considering asking voters to approve yet another set of bonds to catch up.

And all of this happened without a detailed performance audit.

Among the transfers and overruns we’ve discovered in a review of the bond program:

<\!s>City College made up for a planned gym’s mammoth budget shortfalls by transferring more than $53 million from other projects, like the new Performing Arts Center, improvements to the Balboa Reservoir (that massive, sunken eyesore of a parking lot west of the Ocean Avenue Campus), and an academic partnership with San Francisco State University.

<\!s>Construction on the Performing Arts Center was supposed to begin in 2004, but it’s gone nowhere. According to the school’s most recent estimates, the center now will cost $125.8 million, an increase of 152 percent from the original $50 million.

<\!s>Two new campuses planned for the Mission and Chinatown neighborhoods are now running a combined $78 million over budget. School administrators this May requested an additional $6 million to complete the Mission campus. Plans for the Chinatown facilities were originally unveiled in 1997 to voters, who were later told construction would begin in 2006. Today the designs are mired in a political battle with neighborhood residents, and City College hasn’t broken ground on the project.

In at least one case, the school has acknowledged that a $1.3 million reallocation took place without prior authorization from its independently elected overseers, the Board of Trustees. Administrators later asked the board to consent to the transfer retroactively.

"We’re always asked to take this money and move it from here to here," complained trustee Milton Marks III, one of the few consistent critics on the board who in the past voted against such reallocations. "It may be justified…. But when I ask if there are programmatic changes, nobody can answer me."

The school calls the transfers "reallocations," and as of May the administration and the board had agreed to shift the bond money five times.

In one case, administrators asked for $70 million in transfers mere weeks after the 2005 election in which voters authorized the school to sell $246.3 million in bonds.

That January 2006 reallocation strongly suggests the office of Chancellor Phil Day knew the school wouldn’t be able to complete the projects described to voters but never corrected the ballot handbook or told the media and the public the truth.

Day agreed to a Guardian interview, then canceled it, citing a schedule conflict. But in board meetings he and his staff have insisted that the transfers were perfectly legal.

The school’s lawyers say reallocations are acceptable under Proposition 39, a state ballot measure passed by voters in 2000 that lowered the threshold in California for passing school and community college bonds.

Other districts have also relied on reallocations as the cost of construction materials has increased globally in recent years due to Hurricane Katrina and the ongoing expansion of China’s economy.

But the San Francisco school has argued the logical extreme — that it can transform voter-approved projects in virtually any way it deems necessary.

"What obligation do we have in our reallocation considerations about making sure that those things get delivered — all of those projects we listed in both [the 2001 and 2005] bond measures?" former trustee Johnnie Carter asked during a meeting Jan. 12, 2006.

"You have no obligation to complete any of those projects," Mona Patel, a bond advisor for the school, responded. "You can complete one of those projects. You can complete all of those projects or anything in between…. It’s solely within the board’s discretion."

Despite that explanation, City College’s woefully short budget projections mean the school might have to return to voters a fourth time to secure funding for two projects already promised the last time City College went to the ballot, in November 2005.

One of those planned facilities was supposed to house a stem-cell-technology training program lauded by Mayor Gavin Newsom in 2005 as a way to help locals compete for jobs in the Bay Area’s growing biotech and life-sciences research industries. The school stripped $25 million authorized by voters from that project and directed it mostly to two other projects running a combined $105 million over budget.

Marks and new board member John Rizzo have urged an expansive performance audit of the bond money, which they say is required under Prop. 39 but had never been completed.

Rizzo and Marks both told us that if unforeseen construction costs, a low number of project bidders, and the lethargy of state regulators are all problems contributing to unpredicted costs, school administrators need to come up with a plan to fix the situation. But the performance audit proposed by Rizzo and Marks would first identify which problems are most severe. Not having it, Rizzo said, "is like flying blindly. We’re just writing checks."

Peter Goldstein, vice chancellor for finance and administration, insisted to us that state law, as interpreted by the school, doesn’t require the type of audit called for by Rizzo and Marks. It simply requires that the school prove it isn’t spending money on projects not presented first to voters. He added that the reallocations weren’t simple but said he couldn’t answer from memory specific questions about the 2005 bond election, including why the school chose to pursue tens of millions of dollars in reallocations so soon afterward, in January 2006.

"They’ve been very difficult decisions for both the administration and the board," Goldstein said. "[This has] not been some kind of snap judgment. We’ve really had to search and try to make sure there wasn’t some way to contain costs otherwise."

The trustees often seem just as confused as the voters may be about the cost overruns. The trail is laid out in thousands of pages of bond proposals and ever-changing explanatory documents, all complete with glossy schematics and computer-generated students looking gleeful as they head off to class at one or another of the new facilities.

The section of City College’s Web site dedicated to its bond projects is difficult to follow. A brief summary of the projects appears in voter guides, but the full bond proposals are filed with the San Francisco Department of Elections, and you’d have to go there to copy or read the tomes, which contain a lot of qualifying paragraphs that look like this one, which refers to an academic building planned in conjunction with San Francisco State University:

"The college will aggressively pursue state and federal funding to support the ‘joint-use’ concept with San Francisco State University. If funds are not forthcoming, the ‘local’ funds will be utilized to support the construction of the new Child Care Center and the new Student Health Service Center."

Such fine-print disclaimers enabled Chancellor Day and Vice Chancellor Goldstein to later depict multimillion-dollar transfers away from academic construction as entirely legal, even though the Child Care Center and health clinic never appeared as official stand-alone projects in bond proposals presented to voters.

Between 2001 and 2005 the school asked for a total of $40 million to construct in tandem with SFSU the joint-use facility, which was slated to include new classrooms and laboratories where students could work toward bachelor’s degrees in education, health care, and child development. The project is now $26 million over budget and remains in the design phase. Since 2003 about $20 million that voters were told was going to the project has been reallocated to other projects facing increased costs.

A facilities manager at San Jose–Evergreen Community College District, Robert Dias, was incredulous when we presented our findings to him. He said he’d heard of cost overruns statewide but "not to this extent."

"We have experienced rising costs, but we planned for it," Dias said. "Construction costs were going through the roof, but we did creative things to manage it."

On the other hand, Fred Harris, vice chancellor of the California Community College System, based in Sacramento, said the figures didn’t necessarily surprise him and that the state as a result has adjusted its guidelines for what individual school districts can claim as costs.*

San Francisco district attorneys have never been known for fighting political corruption. You don’t see politicians or corporate CEOs doing the perp walk around here — and trust me, it’s not because there’s a lack of criminal activity. Over the past 20 years, I’ve personally written or edited at least two dozen stories that involved clear evidence of lawbreaking by prominent San Francisco citizens, and not one of them has ever been held to account in a court of law.

(OK, I’ll give Terence Hallinan credit for Fajitagate; at least he tried. But it turned out to be an embarrassment when the highest-ranking cops walked away free and clear. And even Hallinan couldn’t — or wouldn’t — lay a glove on Willie Brown.)

Kamala Harris, who will be up for reelection next year, clearly has higher political ambitions. When I saw her take the stage with Sen. Barack Obama at the state Democratic convention in San Diego and he introduced her as one of his most prominent supporters, I could almost see the wheels turning: Federal Judge Kamala Harris. White House counsel Kamala Harris. Even Attorney General Kamala Harris. If Obama doesn’t win, she’s still on a lot of short lists for higher office.

But if she wants to be another Eliot Spitzer, she’s got to, well, be Eliot Spitzer. She’s got to be willing to take a firm hand on political crimes, pursuing and investigating violations of public trust as if that were the most important part of her job.

And she can start right now with the San Francisco Community College District.

It’s been more than a month since the news broke that an associate vice chancellor at City College diverted $10,000 in public money to a private campaign fund set up to pass a college bond act. Nobody’s been charged with any crime, but it seems to me there are some real questions not just about propriety but about legality here. And it seems to me, as someone who has watched that snake pit over there for a long time now, that it’s highly — highly — unlikely that a junior-level college official acting entirely on his own would have shifted 10 grand into a campaign committee that had close ties to elected members of the community college board.

Nobody in the DA’s Office will confirm or deny any investigation, which is standard practice. But I bet an aggressive district attorney who started digging out there on Phelan Avenue might shovel up some serious dirt. Just a thought, Kamala.

I’m beginning to think that our candidate for mayor ought to be Sup. Ross Mirkarimi.

Part of that is, frankly, political reality: Matt Gonzalez shows no sign of wanting to run at this point, and it’s getting late. Sup. Aaron Peskin doesn’t want to do it. There’s talk about former mayor Art Agnos, but I don’t buy it: Agnos would have a lot of fences to mend from his administration, and he’s not the type to apologize.

I hate to say that "leaves" Mirkarimi, because he’s actually a good candidate. He’s smart and full of energy and can take on the mayor on street crime: Newsom is going after panhandlers while Mirkarimi is trying to do something about the appalling murder rate. He’s only been in elected office a couple years, but then, Obama (who is Mirkarimi’s age, to the day) has been in the US Senate a couple years, and he could be the next president. Worth thinking about.

It must suck to be a celebrity reporter for the Chronicle and have your stories buried on page B9. The Chron’s BALCO star Lance Williams has quietly moved into new territory, most recently with a pretty good little scoop on campaign-corruption problems at San Francisco’s City College.

Williams reported first on April 6 that a top official at the school had diverted a $10,000 lease payment belonging to City College (taxpayers, in other words) to the campaign coffers of a committee formed in 2005 to convince voters they should authorize a quarter-of-a-billion dollars in bonds for the school so it could build some new stuff. Follow-ups in the Chron haven’t been immediately easy to find, but they’re nonetheless interesting.

City College has been building new stuff since 1997, and 2005 was the third time they returned to you asking for more money. Spending money on community colleges is good. Spending your money to bankroll a campaign committee formed solely to convince you to spend more money on community colleges is probably illegal.

The first story noted that administrators had also directed a $20,000 lease payment made by a contractor doing very recent business with City College into the same committee’s bank account, but that money was returned several months later. The businesses making the payments were told to just fill their checks out to the campaign fund and bypass the school entirely, even though the school was where the money was supposed to go. When Williams started making calls to City College administrators asking about the remaining $10,000, that money was returned, too.

Williams also identified several businesses that made contributions of $10,000 or more to the campaign committee “within days of negotiating contracts with the community college.”

With Brian Wilson, the Roots, and Common performing and Amy Goodman and Ariana Huffington speaking, how can you miss it?

"Lightning in a Bottle" Live Oak Campground, Santa Barbara; 1-866-55-TICKET, www.lightninginabottle.org. May 11-13. $95-120. It ain’t just a party. It’s a green-minded, art-and-music-focused campout in a forest wonderland. Organized by Los Angeles’s the Do Lab with participation from tons of SF artists, this three-day event is powered by alternative energy, offers ecoworkshops in everything from permaculture to raw foods, and encourages rideshares — including a participant-organized bus trip from San Francisco. Also featuring performances by Freq Nasty, Bassnectar, Vau de Vire Society, El Circo, and other DJs and artists from San Francisco and elsewhere, LIB attempts to change the precedent that festival fun has to be ecologically disastrous.

"Sierra Nevada World Music Festival" Mendocino County Fairgrounds, Boonville; www.snwmf.com. June 22-24, $125 plus $50 per car camping pass. Peace is green, right? I mean, what about Greenpeace? And peace is what this festival, which promotes "conscious" music, is all about. Plus, a range of representatives of environmental and social issues will be tabling at the festival — and registering voters.

BEYOND

"Burning Man" Black Rock City, Nev.; (415) TO-FLAME, www.burningman.com. Aug 27-Sept 3, $250-$280. With its Leave No Trace philosophy and its hippie roots, Burning Man has always been greener than most. But this year it’s getting even more explicitly so with the theme the Green Man, focusing on humanity’s relationship to nature (even though there is no nature on the dry lakebed surface). A pessimist might suggest this year’s theme is just another excuse to waste resources on leaf-themed art cars and that "Leave No Trace" usually translates to "Leave Your Trash in Reno." But an optimist might say this is Burning Man acknowledging and trying to address such issues. Either way, air out your dust-filled tent and pack some chartreuse body paint — it’s going to be an interesting year in Black Rock. *

I get just as crabby and cynical as any other political reporter, but the truth is, on the index of basic competence and lack of corruption, San Francisco city government is doing way better than it was a decade ago.

We’re far from perfect: the Raker Act scandal still sours everything at City Hall, and the mayor hasn’t done much of anything in the past three years. I could go on.

But the reformers have made some tremendous inroads. I don’t know of anyone running a critical department at City Hall who is too drunk to make it back from lunch on a regular basis. Most of the senior staff actually shows up to work instead of spending the day at Nordstrom. The school district has gotten back to educating students, and the public schools improve each year. The supervisors are overall a remarkably smart, progressive bunch. I haven’t seen the FBI raid a local government office in a couple years.

And then there’s the community college district.

The board and the administration that run City College are, I think, one of the last bastions of the kind of inbred, secretive, corrupt rotten boroughs that used to dominate our dear city. Take Lance Williams’s fascinating City College story on the front page of the San Francisco Chronicle on April 6.

Williams showed how a college official, assistant vice chancellor James Blomquist, allegedly steered $10,000 in rent money owed to the school into a campaign fund for a 2005 community college bond act. If that’s true — and nobody’s denying it — the deal was not only inappropriate but blatantly illegal. There should have been outrage all around — but so far only the three dissident members of the community college board have said a word. "Nobody else has said anything," said board member John Rizzo, who with Julio Ramos and Milton Marks III has called for a special meeting on this.

Perhaps that’s because what Blomquist allegedly did isn’t all that unusual at City College, where bond money is moved around and treated like personal scrip by the administration and some of the board members. Remember, these are the folks who promised the voters that they’d build a performing arts center, then turned around and spent the money on a gym — and later agreed to rent out the new pool to a private school across the street (see "Field of Schemes," 9/22/04).

This is the crew that has resisted sunshine, that has run roughshod over neighborhoods and pissed off thousands of people — for absolutely no good reason.

The district attorney needs to investigate this latest scam and ask, among other things, which board members knew about it — because I suspect this wasn’t just a junior official operating unilaterally.

This shit has got to end, folks. The chancellor, Philip Day, needs to go. The board members who have been involved in these past shenanigans (Natalie Berg, Rodel Rodis, and Lawrence Wong) all need to go. The progressives have to make this a priority; City College is a civic gem and a crucial part of the city’s future. It’s infuriating to see it run by political hacks.

And as long as this crew is still in charge, I hope they know better than to come around with their hands out, asking for more of the taxpayers’ money. *

Why does attorney Jim Sutton seem to be involved in every major campaign finance scandal in San Francisco? In the latest, Sutton’s firm reportedly advised a local motorcycle training company on how to allegedly launder money into a City College bond campaign (Sutton isn’t mentioned in the story, but in a letter the company wrote to the Ethics Commission that the Chron featured on today’s front page). Shouldn’t the State Bar take an interest in this at some point?

Never mind the ides of March, here comes year four of the Iraq War. Believe it or not, this whole illegal invasion-and-occupation business brought to you by the generally scary US government — that consortium of oil companies, political marionettes, neoconquerors, military wonks, and other capitalist heavies operating behind the flimflam of democracy and terror — is about to celebrate another birthday. (In various offstage boardrooms, we hear the muffled sound of champagne corks not so discreetly popping.)

It’s unclear how many people are still fooled by the flapdoodle spewing from the faces fronting for this enterprise. For most of us in the big Green Zone back home, questions about the Iraq War have moved decidedly into the cultural realm, where the conflict lingers and ferments like others before it in the atmosphere generated between the TV and the dinner table — or, more insidiously, in the mute wasteland of adolescent malaise, surrounded on all sides by a dysfunctional society in lofty denial of its serious penchant for destruction.

Although written in the aftermath of the Gulf War, that media-sanitized prequel to contemporary carnage, playwright Mickey Birnbaum’s Big Death and Little Death squarely occupies the latter territory. But suburban death metal–laced teenage angst is more than the terrain of Birnbaum’s sly and ferocious black comedy — now enjoying a feisty West Coast premiere by Crowded Fire — it’s a beachhead from which the play gleefully lays waste to the universe as a whole.

Birnbaum’s fully fledged two-act (originally intended as an opener for death metal bands) posits some distorted family values, amplified by the sublimated horrors of a world on fire. Its main characters are a brother and sister, Gary (Carter Chastain) and Kristi (Mandy Goldstone), two sympathetically screwed-up teenagers whose modest nuclear household (an evocative panorama of linoleum, Formica, and faded wallpaper in Chloe Short’s deceptively spare set design) is vaguely overseen by their father, a troubled Desert Storm vet (Lawrence Radecker). Since returning from the Gulf, Dad likes to take pictures of road accidents (your quiet, volatile type, in other words, wonderfully fashioned by Radecker as an opaque yet sympathetic psychopath in desert fatigues). Completing the picture for a time is Mom, or Dad’s unfaithful wife (Michele Levy), whose history of sexual indiscretion while her husband was off sauntering through hell comes tumbling out of her in a series of Tourette’s-like confessions.

In the role of a highly inadequate support circle are Gary’s friend Harley (Ben Freeman), an awkward adolescent with an ambivalent thing for his friend’s sister; Gary’s twisted guidance counselor, Miss Endor (Tonya Glanz), who invites him to a death metal concert before diving into a crank-fueled nihilist rant; and Gary’s inappropriate Uncle Jerry (Michael Barr), a Navy sailor who becomes even more inappropriate as the oxygen leaves the stranded sub from which he makes a farewell call.

When a litter of pups is carted off by a classic suburban tweaker (Barr) in exchange for a gun and a bag of drugs, one of the pups (Mick Mize, in a dog suit) is left behind somewhere to haunt the house and mind of the posttraumatic paterfamilias. This subplot is interspersed with scenes from a family car trip from hell and Kristi’s anorexic adolescent anguish as Gary ponders whether to go to city college or "destroy the universe." In the end, as the characters make love, war, art, and friends in no particular order, the second option looks increasingly enticing to our hero, if only to clear the way for something new.

Smartly staged by Sean Daniels (moonlighting from his position as associate artistic director at the California Shakespeare Theater), Big Death and Little Death speaks to this imploding universe loudly and affirmatively, forefingers and pinkies extended. In Birnbaum’s optimistic apocalypse, there’s a difference between the annihilation of the system and the creative destruction that envisions a new beginning on the horizon.

The umbilical link between big and little deaths brings to mind the Vietnam-era "little murders" in Jules Feiffer’s even more prescient black comedy of an American culture of self-destruction. One’s tempted to call Birnbaum’s play the Little Murders of our day.

But neither can really compete with the culture they so sharply critique nor prove as strange or fitting as the news of the dean of West Point ganging up with human rights activists, the FBI, and military in-terror-gators to chastise the creators of 24 for feeding US soldiers too many tantalizing torture techniques. Seems almost a chicken-and-egg problem at times, this relationship between big death in Iraq (and Afghanistan and beyond) and little death on the tube. It’s quite a food chain too, bringing to mind that serpent devouring its own tail. Come to think of it, Ouroboros would make an excellent name for a death metal band. *

What exactly is Gavin Newsom doing at Delancey Street?

It’s not counseling, we’re told. It’s not rehab. It’s not detox. It’s not a typical course of treatment at the storied $20 million nonprofit. So what is it beyond a reprieve from the otherwise ugly headlines?

Newsom isn’t talking much about his program. But some mental-health professionals are raising serious questions about his regimen.

San Francisco’s chief executive declared several weeks ago in a public announcement to all the city’s department heads that he was seeking a diluted version of rehab at Delancey Street.

That struck more than a few people as odd. Delancey Street doesn’t do part-time or outpatient treatment. It only takes clients who agree to a long-term, full-time residential program geared entirely toward hardcore alcoholics, drug addicts, and criminals.

It’s not, in other words, a place where someone in Newsom’s condition would typically seek help. And it’s not a place designed to alleviate a comparatively minor thirst for white wine.

The news certainly appalled Dee-Dee Stout.

Stout is a City College of San Francisco professor and an adjunct faculty member at San Francisco State University. It’s her job to train city employees working in any major capacity that involves medically treating alcohol and drug abuse, from San Francisco General Hospital to Community Behavioral Health Services to the Adult Probation Department.

Stout, a certified drug and alcohol counselor, told us friends who’d seen the headlines said, " ‘Oh god, Dee-Dee’s going to hit the roof on this one.’ And they were right."

She struggled to figure out how she could broach the subject to one of her classes at City College — but a student beat her to it, quickly pointing out that it was unethical for credentialed treatment specialists to counsel their close friends. The two-year recertification required of caseworkers in the city includes an ethics update, Stout said.

Delancey Street’s executive director, Mimi Silbert, has been Newsom’s friend since he was a child and knows his father well. Silbert, in fact, has openly discussed Newsom’s progress with the press, including the Guardian, while the mayor’s own ear-piercing silence on the matter enables him to appear repentant.

Stout decided to offer the student extra credit if he drafted a letter outlining the concerns of the class, which she had colleagues review before sending it along to the entire Board of Supervisors, the Mayor’s Office, and pretty much every major newspaper in town.

"This relationship is not acceptable under any applicable code of professional ethics," the letter states. Hardly anyone bothered to write back, save for the auto-response letters Stout received from Sophie Maxwell and the Mayor’s Office, plus a letter from Bevan Dufty urging Stout and her students to empathize with Gavin during this difficult time.

Silbert, for her part, told the Guardian that ethics weren’t a concern for her because Newsom wasn’t a full-tilt drunk and hadn’t submitted completely to a detailed treatment plan when he approached her for help.

"The mayor is not a drug addict," Silbert said. "That’s not what he was looking for…. Having stopped drinking, he wanted to take a look at himself. He drank what people would call ‘socially.’ I’ve seen other people when they stopped drinking — even people who didn’t need detox — and there were physical signs of problems. That’s not the shape the mayor was in."

The mayor is attending both group and solo counseling sessions after work each day, a schedule that Silbert told us is still ongoing.

Dannie Lee, a former Delancey Street resident we interviewed, said that during his own stay he attended group therapy three days a week and they were generally no-holds-barred sessions. Lee lived at Delancey Street for three and a half years after spending much of his adult life in California’s prison system. While the program ultimately worked for him, he insists, he’s skeptical that it could benefit anyone who’s trying to attend as an outpatient.

"Maybe it would be great if [Newsom] was actually there as a client or whatever to really sit in a circle and really share his stuff and listen to the group and let the group really attack," said the 49-year-old Lee, who today is one of Stout’s students. "That probably would be fine. But I don’t see that happening…. I think he would really have to tell things I don’t think he wants to tell."

Press accounts have depicted Delancey Street as an abrasive scrub brush for Newsom’s sinful indulgences. "No Nonsense: Toughness Key to Delancey Street, Silbert’s Success," a Chronicle headline announced Feb. 7. Silbert herself told the Guardian, "No one would come near us if they weren’t serious. I’m old, crotchety, and very direct. I have no time to waste."

That may be true — and it’s clear Delancey Street has had some remarkable success in treating people with severe self-destructive impulses.

San Francisco, on the other hand, years ago eschewed the sort of harsh treatment techniques that have made Delancey Street famous.

H. Westley Clark, director of the federal Center for Substance Abuse Treatment and a one-time clinical professor at the University of California at San Francisco, told us that federal mental-health bureaucrats are less inclined today to fund groups that use confrontational methods for treating clients.

Any local nonprofit agency that wants to provide help to substance abusers using city money must comply with San Francisco’s harm reduction policy, which discourages hostile interview techniques and was set in stone by the San Francisco Health Commission seven years ago.

The letter from Stout’s class points out that treatment professionals are moving away from tough-love verbal upbraids such as those employed by the Delancey Street model.

" ‘Attack therapy’ often involves yelling at patients who have, in our view, a medical condition…. While we realize that some patients are helped by strong, confrontational methods, we believe that an evidence-based approach offers more consistent successful results."

Silbert’s techniques may be controversial, but she does move easily among Democratic Party rainmakers and philanthropists. Delancey Street enjoys wide popularity with the likes of Robert Redford, Sen. Dianne Feinstein, the Washington-based Eisenhower Foundation, and executives at the Gap, Pottery Barn, and Bank of America.

Silbert said the mayor deserves credit for whatever help he chooses to pursue. Other prominent friends of Delancey Street have called her before when they needed to "tune themselves up."

"I would never choose to criticize other people’s approaches, so I’m sorry if people are criticizing ours," she said. "We work hard. We do our best…. I’m glad these people feel they have a definitive answer. I don’t, and I’ve been doing it for 35 years."

If Newsom, as Silbert says, isn’t a serious alcoholic, Delancey Street is a peculiar place for him to seek help.

Most people entering the program have hit rock bottom, a step away from death or lifelong incarceration. They’re one-time prostitutes, drug pushers, robbers, and ruthless bangers. Since the organization was formed in the 1970s, it claims to have transformed the lives of 14,000 people through vocational and education assistance in addition to group counseling.

Very few of those people come in for the sort of casual treatment Newsom is seeking. In fact, Delancey Street typically doesn’t accept anyone who isn’t planning on spending a couple years in residence.

Residents living at the Embarcadero Triangle provide labor for several businesses that buoy the nonprofit financially, from its famous Delancey Street Restaurant to a national moving and trucking service.

Newsom for the most part is refusing to answer questions about his now-public battle with booze.

But Stout suggests that Newsom, by allowing the entirety of his treatment to appear on a marquee, has brought the publicity on himself. "Frankly, I don’t think it’s any of our business if he goes to treatment," Stout said. "I wish he would have just quietly gone and did what he needed to do and said he just had some medical things he needed to take care of, period." *

A new direction for City College

EDITORIAL It’s time — way past time — for new leadership on the San Francisco community college board. The panel has devolved over the past few years into a patronage-and-sleaze cesspool allowing an out-of-control chancellor to play games with public money, piss off neighborhoods with ill-conceived development projects, and damage the programs and reputation of the school.

The incumbents who have controlled the board for years — Lawrence Wong, Natalie Berg, Rodel Rodis, and Johnnie Carter — have been active participants in all the problems, and we’ve argued repeatedly that all of them need to go.

In this past fall’s election, a challenger, John Rizzo, defeated Carter, giving the board a very different political character. There are now three solid reform votes on the board — Rizzo, Milton Marks III, and Julio Ramos — and one, Anita Grier, who can be cajoled and convinced to join the right side most of the time.

The board will be meeting Jan. 25 to choose a new president, and by most accounts none of the three top reformers can win the job — but Grier probably can, and she’s a decent choice. At the very least, she won’t play the sort of role that Berg has played in the past as a nonresponsive, unaccountable call-up vote for the chancellor. The vice presidential slot is trickier; there’s a move afoot to award that job to Wong just to preserve some political balance. That would be a huge mistake.

Just look at the recent record: several years ago City College took millions of dollars in bond money that was earmarked for a performing arts center and shifted it to pay for a new gym with a swimming pool that will be rented to a private school across the street. Now the college has approved a $122 million budget for a new 17-story high-rise in North Beach that has the neighbors up in arms — and school officials say they aren’t required to abide by the city’s zoning laws.

The board needs a dramatic turnaround, and the only way to make that happen is to ensure that none of the old guard are in any positions of power. Since Rizzo is new to the board, the best candidate for vice president is Marks, who should have been president last time around but was aced out by Berg and her allies.

It’s been an unwritten tradition on the college board that the person who gets the most votes becomes president; in 2004 that was Marks, who came in with more than 160,000 votes. This time it’s Grier.

Based on their respective popularity with voters, the choice between Marks and Wong for vice president is a no-brainer. Wong was reelected with just 88,000 votes — half as many as Marks.

But that’s not the biggest issue. The real point here is that Wong has no business serving as an officer of the community college board, and Marks does.

Electing Grier and Marks won’t solve all the problems at City College — but it will be a big step in the right direction. *

Careers and Ed: Look Ma, no grants

Starving is overrated. No matter how romantic your notions of the long-suffering, misunderstood artiste, it’s hard to get around the fact that you’ll never get that big one-person show if the rain reduces your paintings to gesso mush because you don’t have a roof to put over them.

Enter the grant provider. Part john, part pimp, and possessing all the bureaucratic zeal of the most exacting mafioso, a grant foundation can seem like an ambivalent overlord to struggling creative types: while most artists want and need grant money, they may find expectations frustratingly impossible to meet. When you factor in an ever-increasing conservatism in the arts-funding world, it’s enough to make anyone wonder how to take artistic risks while still being kept in acrylic paint and photo fixer, much less food.

"That’s the thing about the arts these days. It’s so hard to get your project off the ground," Chesley Chen, a 38-year-old independent filmmaker, says over a piece of Safeway strawberry-rhubarb pie ("It’s surprisingly good") in his Sunset District flat. "The vast sum of money goes to sustain these megalithic art houses rather than nurturing local artists." Chen points out that because of today’s conservatism, most organizations are looking for safe projects to fund — ones lacking controversy and with an obvious social relevance.

It’s ironic, then, that Chen’s latest project is about as socially significant as it gets and yet he’s still struggling to secure meaningful funding. After being moved to tears by a piece in Harper’s last year written by a Ugandan woman suffering from AIDS, Chen began an e-mail relationship with Beatrice Were, an HIV-positive Ugandan mother who started the Memory Book Project for similarly afflicted women. Shunned by their communities because of the AIDS stigma, these mothers are given the chance by Were’s organization to share their thoughts and dreams for and with their children.

Chen soon realized what a powerful documentary the story would make. Problem was Chen found that most funding groups require a pitch reel to give an indication of what a finished project will look like — a logistical impossibility given Were’s location. But for Chen, abandoning the project wasn’t an option, so he was forced to look for alternatives.

SCORING DEVELOPMENT SUGAR DADDIES


Some organizations do offer seed money for projects, but these grants are extremely competitive and definitely for those who don’t mind plenty of demands and hand-holding. Creative Capital (www.creative-capital.org) is unique in that it views its funding model not as a philanthropic effort but as a venture capital investment. Founded in 1999 and offering grants in multiple disciplines, the organization usually works with its artists over a period of three to four years and offers advisory services, continuation funds, and even a yearly retreat. In return, each funded artist agrees to share a small percentage of profits with the group, which is used to fund other works — but only if their project turns a profit. The average grant is for $35,000, but out of roughly 3,000 applications a year, Creative Capital only awards about 50 grants.

For filmmakers, the Independent Television Service (www.itvs.org) offers research and development funding on an ongoing basis in conjunction with PBS. The grants cover expenses such as travel, script development, and the crucial fundraising reel. The group concedes that these funds are "extremely limited and highly competitive," but for those lucky chosen few, the ITVS offers something no other grant provider can: a "comprehensive public television launch" that provides marketing, publicity, station relations, and outreach support. In other words, people actually get a chance to see your work when it’s done.

For the record, Chen has been turned down for both. "With the exception of walking my dog, I don’t think I left my home for three or four days," he remembers. After the initial bout of earth-shattering depression, he decided that if he had to, he would shoulder the whole $60,000 budget himself and just go into debt. "Bankruptcy is not the most desirable thing, but there are worse things to go bankrupt for."

PIMPING POTENTIAL DONORS’ INCENTIVES


Chen decided to get a fiscal sponsor, a strategy he used to help fund his documentary Sandman, which aired on KQED last year. On paper, fiscal sponsorship seems like a counterproductive measure — the artist ends up actually paying the sponsor, not the other way around. But sometimes it makes real financial sense. Because of a sponsor’s nonprofit status, any person or organization making a donation will be able to write it off come tax time. Donations are made to a foundation under the project’s name, the foundation processes the paperwork, and then it gives the money to the artist less a fee. Essentially, the artist is piggybacking on the organization’s charity status. Any nonprofit can offer fiscal sponsorship, but it’s a good idea to go with one that knows what it’s doing — this will involve the IRS, after all. Another big benefit: sponsorship allows the artist to apply for grant funding that is usually only available to tax-exempt organizations.

For Memory Book, Chen is partnering with the San Francisco Film Arts Foundation (www.filmarts.org), which takes 7 percent of funds raised for its fee. This is higher than the 4 or 5 percent fee some foundations charge, but Film Arts makes up for it with a speedy turnaround time. Instead of having to wait for his money for up to seven or eight months, Chen will get it "as soon as the checks clear." Attaining a Film Arts sponsorship can be an arduous two- or three-month process, but the organization’s criteria are based more on fiscal feasibility and sound planning than inherent artistic value. If your fundraising outline consists of, as Chen puts it, a "cupcake sale every Saturday," you’ve got problems.

SHAKING THAT DIY MONEYMAKER


Now that you’re nonprofited up, what’s the next step? For Chen, that was the $60,000 question. First he made sure his current lifestyle wasn’t going to siphon any money away from his project. "I cut out all luxury items," he says. "I stopped going to movies." He budgeted $20 a week for groceries (including pie). "I let my hair grow," he continues. "People wanted gifts for weddings. That wasn’t going to happen. Their present was me not starving."

Then Chen talked to a friend who mentioned she had experience arranging benefit dinners for various causes and asked if he was interested. "It was such a foreign idea," he says. "But she took care of almost everything." That included securing a private chef (who donated his services and provided his home for the feast), contacting retailers such as Mission District specialty grocery Bi-Rite Market (which donated the meat and produce), and convincing wine wholesalers to donate three bottles of vino per course. Students from City College’s culinary department volunteered to serve the 16 guests, who each paid a minimum of $250 to attend. From the dinner alone Chen raised $3,500. It might not sound like much, but put it in perspective: the Uganda hotel for his crew of four will cost $2,000 for the 21-day duration of the shoot.

Chen soon realized that directly soliciting in-kind donations might be the way to go. "Once I got over that initial reluctance, it was actually quite easy," he says. The dinner invitations were sent via e-mail, but Chen snail-mailed subsequent requests for cash for a more personal touch. First he sent requests, complete with self-addressed stamped envelopes, to the wealthiest people he knew, followed by the mere well-off, and finally, friends who may only be able to pitch in $10 or $20. He figures he’ll have raised upward of $10,000 before heading to Uganda this month.

Soon he’ll have his precious fundraising reel, which he plans on using in pitches to the Sundance Documentary Project and possibly HBO. Then, who knows? Maybe he’ll splurge and treat himself to a haircut. *
