Roller derby: the San Francisco treat

Drizzly March was a slow time for San Fran sports fans — the last Super Bowl Sunday pig-in-a-blanket put to bed a month before, the NBA trade deadline past and playoffs a distant dream; and today’s April 1 major league baseball opening games an agonizing countdown away. Short of swimming through the dreary rains to San Jose’s Shark Tank, what’s a rowdy, rooting beer-guzzler to do?

Heading to Golden Gate Park to cheer on some equally rowdy rollers might not be the first thought that comes to mind, but it’s exactly what thousands of die-hard derby-goers did on March 19, when the storied San Francisco Bay Bombers elbowed past the Brooklyn Red Devils in the American Roller Skating Derby league’s world championship game.

Some may not consider a wet night in a packed Kezar Pavilion to be a legit answer to the pro-sports dry spell. But the Bay Area-based ARSD league is serious about its professional status, taking pride in everything from the team uniforms to the traditional banked track – a far cry, if you please, from the fishnets and flat floors of newer leagues

Bombers’ general manager Jim Fitzpatrick, who skated for the team from 1977 to 1987, has now delivered his third straight league title since rejoining as GM in 2007 (the ARSD doesn’t hold its championship game every year). For his efforts, he’s received three straight general manager of the year awards. But for him, the real thrill is keeping banked track derby – and its SF history – alive. 

“As a little kid growing up in San Francisco roller derby was huge,” Fitzpatrick said. “Everyone watched the Bombers on TV, everyone knew them. I dreamed about playing for them in Kezar. Now, I want to honor the tradition of the old derby.”

The venerable “old derby” is rooted in19th century roller marathons that lasted for days, sometimes caused deaths, and, on the whole, managed to acquire a reputation as less-than-legitimate. The sport was popularized as a Depression-era divertissement by Chicagoan Leo Seltzer, who in 1935 built a banked track and took it on the road, dubbing it the Transcontinental Roller Derby. At each stop, skaters would circle the wooden ring as many as 57,000 times, simulating a days-long journey from New York to California, with lit-up placeholders marking teams’ make-believe progress across a billboard-sized map of the U.S.. 

Derby historians credit crowds’ hunger for blood (not that 57,000 laps would be tedious otherwise, Nascar notwithstanding) with the spectacle’s increasing focus on physical contact and frightening pile-ups. The endurance element gave way to a derby more similar to that of today, where a “jammer” on each team gains points by bumping, jumping and jostling past opposing teams’ “blockers.” 

In 1949, Seltzer created the National Roller Derby League to showcase the scintillating sport, which was poised to become a television sensation. Echoing his earlier pilgrim’s progress, he packed up the whole shebang and moved it first to Los Angeles and then to the Bay, where the 1954 formation of the San Francisco Bay Bombers created a lasting sports legacy with some of the game’s most enduring stars. (Bomber Joanie Weston was even reputed to be the era’s highest-paid female athlete.) 

The iconic Bombers were the epitome of the banked track derby that aficionados like Fitzpatrick remember watching on their family room TV sets as youths. Dozens of games a year were taped in Kezar Pavilion, adjacent to then-home of both the Oakland Raiders and the San Francisco 49ers. From there, KTVU broadcast Bombers’ games to hundreds of cities nationwide, making roller derby the Rice-a-Roni of sports, synonymous with San Francisco. 

Seltzer eventually transferred ownership to his son, Jerry, who would later recall the glory of San Francisco’s skating days, when Kezar regularly sold out. And just for an added taste of legitimacy: the Bombers shared locker rooms with their NFL stadium-mates. 

“There were no dressing rooms in Kezar Stadium,” the younger Seltzer wrote in a blog he kept, “so when the 49ers played a home game they used the tacky dressing rooms in the Pavilion. Sometimes there was virtually no overlap between the time the players left and our teams arrived, to really scummy and wet dressing rooms.” 

Fitzpatrick affirmed that the dressing rooms still exist today, though Kezar Stadium has been knocked down and rebuilt. Under the parking lot, connected to a tunnel that once funneled the teams out to a roaring crowd, the rooms are a kind of shrine to days-gone-by – days when the 49ers and the Raiders would lace up roller skates and join the Bombers on the banked track, sometimes indulging in a bit of competitive action off the football field.

“Of course,” Fitzpatrick said, “That was before the NFL took off and salaries skyrocketed.  Once that happened, the guys couldn’t afford to be fooling around.”

Though their fun ended, there was still plenty of thrill left on the banked track. The ‘60s marked the height of television popularity for the Bombers who, across the nation, were considered the team to beat.

Seltzer’s league folded in 1973, a disaster attributed to everything from the rising cost of fuel to the diversification of televised sports and events. Since then, leagues have appeared, disappeared, fractured and gone defunct, the sport’s popularity waxing and waning, the focus shifting between skill and sensation. 

“Other games and jams have come along,” Fitzpatrick explained, applying the term “silly stuff,” to a whole array of roller sports, from L.A.-based Roller Games to CBS’ over the top show Roller Jam. Fitzpatrick even alluded to “midgets on skates” – and while that might be happening somewhere out there, it doesn’t take tiny rollers to get folks to think of derby as sports entertainment: the WWE on wheels, with sexpot women in the starring roles. 

Mixed-gender for-profit leagues like the Bombers’ league ARSD leave off the false eyelashes, but fans still debate whether the scores – and punches – are fake.

According Fitzpatrick, the Bombers’ aggression is all real.

“It’s a competitive sport,” he said, “based on contact and maneuverability. It’s like when someone cuts you off on the road – like road rage, tempers flare.”

Fitzpatrick’s sincerity never falters, and it’s clear he’s proud of his skaters when he describes how player coach Richard Brown scored the last point of the 43-40 game despite sweltering heat, or when he hails rookie Crista Chua as the female standout who learned under fire and performed under pressure, despite the championship being only her second real game.

And for their part, the players are just as serious. Chua said she trains hard for the team, staying in shape with running, weights, extra skating practices, and yoga sessions to stay flexible. 

Despite the sensationalism, Fitzpatrick’s goal is to keep roller derby on track – and so far, his efforts have resulting in a sterling record. Will it ever be as good as lacing up the ol’ skates for a game of his own? According to Fitzpatrick, it’s even better.

“To see something completely disappear, and then to be able to carry on – I’m that much more grateful,” he said.

As for the future: “I want to keep on the path, looking ahead to great skating and great ability. There’s always going to be showmanship in every sport, but I want to honor the athleticism.”

 

Redevelopment debate full of bum choices

At the Potrero Hill Democratic Club’s debate about Gov. Jerry Brown’s proposal to ax local redevelopment agencies to balance the state’s $26 billion deficit, folks attempted to evaluate if redevelopment agencies are essential for job creation and community revitalization, if reform, not total destruction, is possible, and if bum choices are all we have to look forward to.

The Chronicle’s Marisa Lagos, who moderated the debate, noted that redevelopment agencies were created over 60 years ago to create economic development opportunities by borrowing against future tax increases that agencies think they can create.

 “That’s a fancy way to say ‘borrow against future taxes,’” Lagos joked, pointing to the Candlestick Point/Hunters Point Shipyard project as an example of an ongoing project, and the Yerba Buena project as an example of a completed success.

 “The Governor is arguing that when the state is cutting schools and other essential services, this is not the best use of tax dollars,” Lagos stated.

 Panelist Olson Lee, deputy executive director of San Francisco’s Redevelopment Agency, pointed to affordable housing as evidence of the agency’s positive impact.

 “I think Redevelopment is important because of the good things it has done,” Lee said, pointing to 11,000 units of affordable housing that the agency helped build in the city.

 Panelist Carroll Wills, the communications director for the California Professional Firefighters, said “many wonderful projects” have occurred under Redevelopment. But he pointed to what he called “a decade of tricks and games,” on the part of Redevelopment agencies as one reason why the state is in a fiscal crisis that threatens firefighters’ jobs.

 “Concrete does not trump core services,” Wills said, arguing that it’s not clear that many affordable housing projects would not have been built without redevelopment aid

Arc Ecology’s Saul Bloom accused Gov. Brown of “short-circuiting” what could have been an important statewide discussion about redevelopment reform, with his bombshell suggestion in January to eliminate redevelopment agencies entirely

 “I’m sympathetic to the argument that Redevelopment takes money away from core services,” Bloom said. “But what do we do to replace it? And is economic development versus core services a false choice?”

Lee pointed to Mission Bay as further evidence of Redevelopment’s success.

“It was considered a brown field, and through development, it’s much different,” Lee said, noting that 20 percent of tax increment financing goes to the General Fund to pay for redevelopment infrastructure. “Clearly the university would not have been there. It was an opportunity to place UC there and generate economic opportunities.”

 Wills argued that Redevelopment Agencies are a luxury we can no longer afford, even as he acknowledged being unfamiliar with local redevelopment projects.

“At best, redevelopment moves around the pieces,” Wills said. “It doesn’t increase economic development and it doesn’t necessarily pay for itself.”

Bloom noted that developments like Mission Bay are dependent on large institutions, like the University of California, which can’t be forced to implement city laws like local hire.

And he said he found it “disappointing” that there wasn’t much more of a dialogue around the plans to redevelop Candlestick Point and the Shipyard, despite the fact that the city held hundreds of meetings over the past decade.

“It was more a case of, Here’s our idea, tell us what you think of it,’” Bloom said. “Perhaps if we had invited the nation’s largest industrial developer, instead of the nation’s second largest home developer, we would have had a different dialogue.”

 Lee replied that the Shipyard has been under discussion for 15 years.

“It’s a very large project, the largest in the Western United States,” Lee said. “It’s a brownfield, though I know Espanola will say it’s a Superfund site,” he continued, as Bayview elder Espanola Jackson bristled under her hat, and the audience wondered if Lee meant that the US E.P.A. somehow got it all wrong.

Lee further shocked audience members by saying Treasure Island was not a redevelopment project (leading Bloom to clarify that Treasure Island is under the jurisdiction of the local Treasure Island Development Authority, if not the SF Agency).

“People felt they wanted economic development at the shipyard,” Lee continued, noting that the neighborhood suffered after the Navy withdrew from the shipyard in the 1970s. But he did not mention that major bones of contention around the redevelopment proposal, centered on plans to build 10,000 mostly market-rate condos, a bridge over an environmentally sensitive slough, the taking of a chunk of the community’s only major park, and no proof that thousands of promised jobs will materialize.

Wills noted that most local redevelopment commissions are peopled by the members of each municipality’s city council, a situation he believes leads to a lack of accountability. But members of the audience, including this reporter, noted that San Francisco’s Redevelopment Agency consists entirely of mayoral appointees, who, unlike elected officials, can’t easily be voted off the proverbial island.

It was at this point that panelist Calvin Welch, a longtime housing activist, showed up at the debate, apologizing for being late, but blaming his tardiness on being on a phone call with Sen. Mark Leno to discuss Brown’s redevelopment proposal.

And from there, the conversation veered towards discussions of what could happen to existing redevelopment projects if Brown goes through with his elimination threat.

 Lee noted that if projects simply had a disposition and development Aagreement (DDA), but Redevelopment was no longer there, there would be no project financing. “The devil’s in the details,” Lee said. “Because if you don’t have bonds, what’s the point of having an agreement.”

 Wills opined that Gov. Brown’s proposal has “a vehicle to roll back the bum’s rush” of projects that local municipalities have been trying to push across the finish line, ever since Brown dropped his Redevelopment elimination bomb in January.

 Welch went off on a historical riff about how the San Francisco Redevelopment Agency (SFRA) was met with controversy and outrage until 1988, when Art Agnos was elected mayor, and brokered a deal under which SFRA could do tax increment financing, provided the majority of funds were used for affordable housing.

“It became a finance agency to build infrastructure and affordable housing,” Welch said, noting that attempts to build out Mission Bay around commercial offices and high rises failed, until the Agency used tif to redevelop the site.

 “But mark my words, Lennar is going to come out of this just fine,” Welch added, reminding me of a recent comment that former Lennar executive Emile Haddad reportedly made that suggests Haddad believes the California housing market is poised for a rebound.

(The article outlined how Haddad sold 12,000 acres in California for a $277 million profit at the housing market’s peak four years ago, reacquired it at half the price in 2009, and is now saying it’s time to build in his new role as CEO of FivePoint Communities Inc., which is developing four new master-planned communities with a combined 45,000 residences at Newhall Ranch north of L.A., the El Toro Marine Corps Air Station in Orange County, the Candlestick Point/Hunters Point shipyard and Treasure Island  in San Francisco, with investors including Lennar, Michael S. Dell’s MSD Capital LP, Ross Perot Jr.’s Hillwood Development Co. and Rockpoint Group LLC. “I don’t want the party to show up and I’m not dressed,” Haddad, 52, reportedly said in a recent interview. “When the market says ‘I’m here,’ we’ll be one of the few that can deliver inventory.” 

(The Haddad article, which appears to be a non-bylined reprint from Bloomberg News, also claimed that Hunters Point sales are set to begin by late 2012 with prices starting at $525,000, as the Navy continues its cleanup of the 700-acre site. And that the plan now calls for as many as 12,000 homes, 3 million square feet (of commercial space and a new stadium for the 49ers. And that 7,000 homes may eventually be built on Treasure Island and adjoining Yerba Buena Island, under terms of a final development agreement that may go before the San Francisco Board of Supervisors for approval in May, with units averaging  $800,000 and reaching up to $2 million, according to Lennar V.P Kofi Bonner.)

And during the Potrero Hill Dems debate, Bloom noted that the Treasure Island plan is being “sped up” and that the Board is expected to vote on the plan as soon as possible. “But since these plans were not bonded before January [when Gov. Brown took office], what’s the point of speeding up the process?” Bloom asked.

“We’re basically seeing a brick wall,” Welch interjected. “There are virtually no funds for permanent affordable housing in San Francisco.But Jerry Brown is not going to commit financial hari kari. Every major developer of market rate housing will come out just fine, because of state actions, not because of a local vote. Deals are going to be made. It’s the question of affordable housing that’s our challenge. You’re gonna be stuck with public housing, as it is, unless there’s affordable housing financing.”

 Wills claimed that Prop. 22, which voters approved last November, “created a mechanism so rigid,” that the state’s only option was to eliminate redevelopment. “Basic services are dying on the vine,” he said. “We can’t afford to give developers subsidies.”

 Lee noted that SFRA built thousands of affordable units over the years that saved the city thousands in terms of core services it would otherwise have to provide. “Affordable housing is so basic, you can’t do things we take for granted if you are living under a freeway,” he said.

 Bloom suggested Redevelopment could do a better job of economic development, including the creation of permanent and sustainable jobs, like his proposal to create maritime uses at the Shipyard—something not entertained under the city’s Shipyard plan.

 Welch connected the dots between the taxpayer revolt that led to Prop. 13’s passage and the current fiscal woes of municipalities unable to raise taxes on commercial development. “That’s a killer,” he said, noting that housing costs more to build and maintain than it generates property taxes, especially if it’s family housing. ‘It’s those damn kids,” he joked.

Welch noted that Gov. Brown used redevelopment money to enable market rate development in downtown Oakland when he was mayor of Oakland—and claimed that Brown equated affordable housing with crime, at the time.

“We love Brown better than Meg Whitman, but it’s 2011 and we face bum choices.”

Community advocate Sharen Hewitt, who heads the C.L.A.E.R. project, asked if the panel thought San Francisco could be a “demonstration model” for using Redevelopment funds to build 50 percent affordable housing.

Welch said conversations have “already happened” between Mayor Ed Lee and Gov. Jerry Brown that have led him to believe that, “all of San Francisco’s redevelopment projects will be made whole, affordable housing will be protected and Brown will be committed to a San Francisco model.”

“It’s like the film Casablanca, when people are shocked to find out that gambling is going on in a casino,” Welch said. “People are shocked to find out that capital talks in a capitalist system.”

 Espanola Jackson asked Welch what will happen to the shipyard development, in face of a lawsuit that POWER brought that’s due to be heard March 24.

“The shipyard plan has a political function,” Welch said, noting that it was the result of a citywide vote in 2008. ‘We opposed it, but we lost. The structure of that deal flows from the vote.”

 City College Board member Chris Jackson expressed frustration that the Redevelopment conversation had devolved into a housing conversation.

“Mission Bay is all about biotech, but who works at UCSF?” Jackson said, noting that Redevelopment, as a state-funded agency, does not have to agree to the city’s newly approved local hire law.

Welch acknowledged that there has never been a study to determine the tipping point required to lift the Bayview out of poverty.

Lee admitted that Redevelopment’s focus has been housing, “because San Francisco is such an unaffordable city.” But he claimed that SFRA had a “much more aggressive program on local hire than the city, for many years.” Noting that SFRA has tried to attract restaurants and food establishments to Third Street, over the years, Lee said, “It hasn’t been something we’ve been particularly successful at.”

Welch opined that the “skills and abilities of the San Francisco community are far greater at stopping projects and protecting neighborhood character, but we can’t figure out how community-based organizations can employ their own people.”

 And then it was time to go back out into the cold March wind and try to wrap our minds about the true meaning of “bum choices” in 2011.

SF’s redevelopment miracle

OPINION While many of us (and most of the rest of the state) can tire from time to time when we hear San Francisco “exceptionalism” being touted, especially when Gavin Newsom is doing the touting, there are some cases in which it’s justified. One of the most salient is the way San Franciscans transformed the city’s Redevelopment Agency and used tax-increment financing to build housing and infrastructure that served its residents, not elite developers.

This is an exceptional story that Gov. Brown does not want to hear. He should both listen and learn from San Francisco’s experience.

The San Francisco Redevelopment Agency started out like all others: destroying low income neighborhoods to create what the San Francisco Planning and Renewal Association, a strong agency supporter at the time, called ” ‘clean’ industries [and a] population … closer to ‘standard white Anglo-Saxon Protestant’ characteristics … ” But the big difference was that San Franciscans fought back.

In the 1960s in the Western Addition and SoMa, community organizations were formed that sought legal assistance and stopped the agency in its tracks. In the 1970s, new community coalitions were formed to deny the agency new federal funding. By the 1980s, the agency was broke and its mission of urban renewal so blocked and discredited that SPUR changed the last two words in its name from “Urban Renewal” to “Urban Research.”

In 1988, Mayor Art Agnos brought in the opponents of redevelopment and asked them how to redesign the agency. The product of that collaboration was a new mission statement and an ordinance fully integrating the agency into city government — transforming it into a financing agency, with no operational role.

Since 1990, the agency has become the major funder of affordable housing in San Francisco, pouring more than $500 million into low-cost housing both inside and outside redevelopment areas. More than 10,000 units have been built for working and low-income residents, more than half of those units for families with children. The urban infrastructure needed to transform Mission Bay from a toxic rail yard to a residential and biotech center came from the agency. Since 1990, not one neighborhood has been bulldozed by the agency and two new ones are being created (Mission Bay and Transbay).

Yes, some of the tax increment has been used to do some infrastructure work at ATT Park, and former Mayor Gavin Newsom wanted to entice the 49ers with agency funds for a new stadium at the shipyard. And yes, former Mayor Willie Brown gave Bloomingdale’s some agency money for its Market Street store. But the reality is that 50 percent of all tax increment since 1990 has gone to affordable housing development, and the bulk of the remaining 50 percent has gone for critical needed infrastructural work that has produced new property taxes more than paying for the investments. As the state and federal government turned their backs on central cities it was the only form of financing available.

And now Gov. Brown wants to end tax-increment financing. He points to the excess of other redevelopment agencies in other places. He does not, however, look to us and our experience. He should. San Francisco should be the model for what is required of all redevelopment agencies.

After serving as mayor of Oakland, Brown is probably tired of hearing about how different San Francisco is, how exceptional we are. That’s too bad, because in this case it isn’t hype. It’s real. *

Why it has to be Green Bay

I mean, not if the 49ers were playing. And I have this ancient loyalty to my old hometown Jets, who won Super Bowl III against Baltimore when I was 11 years old. (I still remember Joe Namath sitting by the pool the day before, sipping a drink and proclaiming that his 21-point underdog team was so certain of victory he could “guarantee it.” And Joe was cool. A jerk, but cool. And Emerson Boozer was a great name for a running back.)

I was a bit of a Steelers fan, too, during the days of Terry Bradshaw and Franco Harris and Mean Joe Green (before the Coca Cola ad, barf).

But in the end, you have to root for the Packers. And not just because Aaron Rodgers went to Cal and got picked 24th (when the Niners could have had him but took Alex Smith instead, look how well that worked out) and had to wait patiently for Brett Favre to move on. I’ve always supported Green Bay because it’s the only publicly owned team in professional sports.

Okay, not exactly publicly owned: The city of Green Bay doesn’t hold the title deed. But it’s pretty close — there are 112,158 shareholders, most of them part of the Green Bay community in one way or another. There’s no majority owner — and it’s a functioning nonprofit. None of the shareholders get dividends; all the money is put back into the team. The Packers can’t leave town and can’t be sold.

The model so freaks out the NFL that the league passed a rule a few years ago barring any more teams from using it; now, there can be no more than 30 shareholders of any team and one must hold 30 percent of more and be the principal owner.

If all the teams were like Green Bay, there’d be no lockout, no Baltimore Colts splitting town in the middle of the night, no Al Davis jacking up Oakland. Go Packers.

 

The deal is done

Mayor Gavin Newsom was quick to frame the Board of Supervisors’ 10-1 vote for Lennar Corp.’s massive redevelopment proposal for Candlestick Point-Hunters Point Shipyard on July 27 as a sign that plans to revitalize the Bayview are about to begin.

“Now we can truly begin the work of transforming an environmental blight into a new center of thousands of permanent and construction jobs, green technology investment, affordable housing, and parks for our city,” Newsom claimed in a prepared statement after the board (with Sup. Chris Daly as the lone dissenter) approved Lennar’s 700-acre project.

The proposal calls for 10,500 residential units; 320 acres of parks, retail and entertainment facilities, green-tech office space; and a San Francisco 49ers stadium if the team decides not to move to Santa Clara.

But Kofi Bonner, who worked for Mayor Willie Brown before becoming Lennar’s top Bay Area executive in 2006, said the vote means he can start shopping the plan around. “Now we have to find some money to move forward with the project,” Bonner told the San Francisco Chronicle.

Given the stubbornness of the recession, Bonner’s revelation that Lennar has yet to find all the necessary investors means local workers and public housing residents could be waiting a long time for jobs and housing in Bayview. If and when the project finally breaks ground, it will involve building condos in the Bayview’s only major park.

These realities undermine the claims of Lennar, which used the mantra of “jobs, housing, and parks” in 2008 to sell Proposition G but made no mention of a bridge over environmentally sensitive Yosemite Slough or selling state parkland for condos.

Also disturbing, says Sierra Club local representative Arthur Feinstein, is the lack of any economic analysis to support Lennar’s claims that the bridge is needed.

Indeed, the only thing clear to longtime observers of the plan is that the much vaunted jobs won’t happen soon, most of the housing will be unaffordable to current Bayview residents, and Candlestick Point State Recreation Area, the only major open space in the Bayview, will be carved up so Lennar can build luxury condos on waterfront land.

These concerns have led the Sierra Club to threaten a lawsuit over issues on which Board President David Chiu was the swing vote in favor of the Lennar and Redevelopment Agency plan. Yet Chiu told the Guardian that the process got him thinking that it might be time to reform the redevelopment process.

“Now might be a good time to address concerns about the potential for inconsistency between Redevelopment and the city when it comes to land use and planning visions,” Chiu said. “And I have concerns about the tax increment financing process.” Tax increment financing allows the Redevelopment Agency to keep all property tax increases from the project, up to $4 billion, to use in redevelopment projects rather than into city coffers.

Chiu says the amendment he offered July 12, which narrows Lennar’s proposed bridge over Yosemite Slough by half, was based “on the belief that having a connection between jobs and housing is important. And I had understood that it would cost the developer an additional $100 million if the bridge was removed.”

But Feinstein counters that it’s hard to imagine that building a bridge over an environmentally sensitive slough will attract investors that support green technology. He is concerned that the development is expected to attract 24,465 new residents but that the Lennar plan fails to mitigate for transit-related impacts on air quality. “The Bayview already has the highest rates of asthma and cancer in the city,” Feinstein said.

Chiu says the supervisors can introduce separate legislation to address this concern. “It’s my understanding that an air quality analysis could be implemented by the board,” he said.

Although the board’s July 27 vote was a relief for termed-out Sup. Sophie Maxwell, its failure to support the no-bridge alternative, increased affordability standards, and an air quality analysis could result in expensive and time-consuming litigation, Feinstein warns.

And although Sups. Chris Daly, Ross Mirkarimi, David Campos, John Avalos, and Eric Mar supported all three of these amendments, they were ultimately thwarted by a redevelopment law that limits the city’s control of such projects.

During the meeting, Daly acknowledged that it would be impossible for Lennar to meet his 50 percent affordability amendment. But he noted that if the project becomes too expensive “there’s going to be a pretty new neighborhood with lots of white folks living in the Bayview.”

But after Michael Cohen, Newsom’s top economic advisor, said the project would not be financially viable with 50 percent affordability, Sups. Chiu, Maxwell, Bevan Dufty, Michela Alioto-Pier, Carmen Chu, and Sean Elsbernd voted against Daly’s amendment.

These same six supervisors voted against Mirkarimi’s proposal to eliminate plans for a bridge across Yosemite Slough, even though Cohen was unable to point to any economic analysis to support Lennar’s claims that the bridge is necessary.

Arc Ecology owner Saul Bloom, whose nonprofit did studies indicating that an alternative route wrapping around the slough is feasible, says Lennar’s plan illustrates the problem that San Francisco has with development. “Elected officials couldn’t do anything,” he said, except give the nod to a plan he describes as “developed by a mayoral administration and approved by that mayor’s political appointees [on the Redevelopment Agency board],” Bloom said.

“The message that the environmental community takes away from all this is that it doesn’t pay to play well,” Bloom continued. “No matter how much you spend to try and ensure that litigation is not the only way to obtain the desired outcome, ultimately the message that comes back from the city and the developer is ‘sue us!’ That brings out the worst political conduct, not the most appropriate.”

Feinstein wouldn’t confirm that a Sierra Club lawsuit is imminent, but predicted that if the coalition — which includes Golden Gate Audubon, the California Native Plant Society, and SF Tomorrow — goes to court, it’s likely to win. “If we do litigate, we’ll probably do it on a wide range of issues,” Feinstein said. “They approved a fatally flawed document, and they could provide no documented evidence of the need for a bridge — and admitted that publicly.”

Feinstein contends that Lennar’s plan has been a runaway project from the get-go. “The idea was to march it through before the mayor is gone with little regard for process. And despite all the much vaunted public meetings, little in the plan has changed,” he said.

Feinstein added that he was disappointed in Chiu’s stance on the bridge. “There were five supervisors in the Newsom camp, but as board President, Chiu had a responsibility to be more vigilant,” he said. “We told him what’s wrong with the bridge plan, but he didn’t share our view.”

“This is a rare opportunity,” Maxwell said before the board’s final vote. “It focuses public and private investment into an area that has lacked it in the past. It’s unmatched by any development project in San Francisco. This project is large and complicated, no doubt. But let us not be fearful of this project because of its scale, because how else can we transform a neglected landscape?”

But project opponents say everyone should fear a deal that required the board to ask Lennar’s approval to amend a plan that was pitched by the Newsom administration and approved by a bunch of mayoral appointees on the Redevelopment Commission with little chance for elected officials to make changes.

Mirkarimi said the problem with a process in which redevelopment law trumps municipal law is that it creates a shadow government in those few municipalities in California where the Board of Supervisors or City Council is not the same entity as the Redevelopment Commission.

“This is not the first time Redevelopment’s plans have trumped the concerns of local residents,” Mirkarimi said, referring to the agency’s botched handling of the Fillmore District in the 1960s, which led to massive displacement of African and Japanese Americans.

“I’ve been told, ‘Don’t worry, Ross, this is not going to happen, we’re not going to use eminent domain.’ Well, jeez, that’s a consolation, because even when we’ve exercised our legislative influence and given our blessing, [Redevelopment] unilaterally changed the plan after it left the board,” Mirkarimi said, referring to Lennar’s decision to replace rental units with for-sale condos when it first began work on the shipyard in 2006. “That suggests a condescending role in which the developer is able to go to the Redevelopment Commission and make a unilateral change.”

Mirkarimi’s concerns seemed justified after Cohen, Bonner, and Redevelopment Director Fred Blackwell huddled in a corner of City Hall during the board’s July 27 meeting to decide which of the supervisors’ slew of amendments they would accept. When Cohen returned with the amendments organized into three categories (acceptable as written, to be modified, and completely unacceptable), Mirkarimi’s no-bridge amendment had been sorted into the “unacceptable” pile.

“With regard to your insistence on the economic reasons [for the bridge], please point to which document says that,” Mirkarimi said, leafing in vain through the project materials.

Cohen mentioned “a lessening of attractiveness,” “a lower-density product,” and a reduction of revenue available through tax increment financing to pay for the bridge.

“Yes, but I’m still trying to look for the information and all I’m hearing is this pitch,” Mirkarimi said. “The economic study is absent. There are no supporting documents here. This is why I feel it’s justified for us to have a review of this.”

Cohen rambled on about “rigorous public discussion over a number of years” and claimed that a “huge amount of studies had been done.”

“But there is no economic study,” Mirkarimi repeated.

The board then voted 6-5 against Mirkarimi’s amendment after deputy City Attorney Charles Sullivan said that the only way to remove the bridge — since the project’s environmental impact report had rejected that option — would be to reject the entire plan. “I wish we had been able to eliminate the bridge,” Campos told the Guardian after the vote. “Part of the challenge we have is to reexamine how Redevelopment works and explore the potential for taking it over.”

Daly believes the bridge has nothing to do with connecting the neighborhood to the city. “The idea is to allow white people to get the fuck out of the neighborhood,” he said. “And it connects a different class of people to a new job without having to go through a low-income community of color. That’s why the bridge is needed.”

Mirkarimi said he was satisfied that he had dissected the arguments against the no-bridge alternative but fears that institutional memory is lacking on the current board. “A lot of my colleagues have not been involved in the debacle,” he said, referring to decades of problems with redevelopment in San Francisco. But Maxwell was all smiles. “I did my homework a long time ago — that’s why they couldn’t touch the core of the project,” she said. “They just added to and augmented it.”

The Board of Supervisors found itself in the humiliating position July 27 of having to ask for the approval of Lennar and the city’s Redevelopment Agency before it could amend Lennar’s massive redevelopment plan for Candlestick Point-Hunters Point Shipyard.

If that’s not an argument for reforming how this city approaches redevelopment, I don’t know what is. Especially since the Board’s meeting illustrated only too well how thoroughly Lennar’s local executives, who used to work for the city under Mayor Willie Brown,  understand this game and how to outfoxed any resistance to their ongoing effort to eat San Francisco whole.

“This is a rare opportunity,” Sup. Sophie Maxwell said ahead of the Board’s 10-1 vote (Sup. Chris Daly was the lone dissenting voice) to approve Lennar’s entire plan. “It focuses public and private investment into an area that has lacked it in the past,”continued Maxwell, who represents the district that encompasses the shipyard and Candlestick Point. ” It’s unmatched by any development project in San Francisco. This project is large and complicated, no doubt. But let us not be fearful of this project because of its scale, because how else can we transform a neglected landscape?”

But who wouldn’t be afraid of a deal that found Maxwell, Board President Chiu and Sups. Michela Alioto-Pier, Carmen Chu, Bevan Dufty and Sean Elsbernd joining forces to vote against Sup. Ross Mirkarimi’s proposal that Lennar be required to include a non-bridge alternative?

And who wouldn’t be doubly afraid, given that these six supervisors took that vote after Michael Cohen, Mayor Gavin Newsom’s top economic advisor, was unable to point to a single document to support his claims that Lennar’s $100 million bridge over an environmentally sensitive slough is actually needed?

Talk about scary.

To his credit, Mirkarimi did a good job of illustrating what’s wrong with a process that allows a private developer like Lennar to pitch plans and get mayoral appointees to approve them, but doesn’t allow San Francisco’s elected officials to make any amendments unless the developer and Redevelopment agree.

At the root of this travesty is the fact that redevelopment law trumps municipal law, a power imbalance that creates a shadow government in those few municipalities in California where the city council or board of supervisors is not the same entity as the Redevelopment Commission.

San Francisco is one such municipality, and, as Mirkarimi explained, this is not the first time that Redevelopment’s plans have trumped the concerns of local residents.

“I’m the supervisor for the Fillmore, the first urban renewal laboratory took place in my district, and I vowed to never let it happen again, ”Mirkarimi said, referring to the massive displacement of African Americans and Japanese Americans that took place when Redevelopment decided to makeover the Fillmore in the 1960s.

“I’ve been told, “Don’t worry, Ross, this is not going to happen. We’re not going to use eminent domain,’” Mirkarimi continued. “Well, Jeez, that’s a consolation! Because even when we’ve exercised our legislative influence and given our blessing, [Redevelopment] unilaterally changed the plan after it left the Board. That suggests a condescending role in which the developer is able to go to the Redevelopment Commission and have a unilateral change.”

Mirkarimi was referring to how proposed rental units on Parcel A, the first parcel of shipyard land released for redevelopment, became for-sale condos at Lennar’s request, without the Board having any recourse, even though the area surrounding the redevelopment is ground zero for the city’s last remaining African American community and home to other low-income communities of color.

Deputy City Attorney Charles Sullivan explained that the s supervisors would require the approval of the developer and Redevelopment to amend Lennar’s latest plan, under Redevelopment law. Failing that, their only recourse would be to reject Lennar’s plan in its entirety–a nuclear option that only Daly seemed prepared to carry through.

Sup. David Campos noted that the city’s legal advice had been “somewhat of a moving target.” His comment suggested the Board had  been misled in the critical weeks before this final vote, including ahead of the Board’s July 14 vote to accept certification of the project’s final environmental impact report.

“When a number of us raised questions about the EIR, we were told we couldn’t, but that we would probably be able to make changes to the substantive plan,” Campos recalled. “But now we are getting a more complicated answer.”

Deputy City Attorney Sullivan said the situation was complicated, because some of the proposed amendments “don’t involve a simple stroke of the pen.”

But Campos pointed to the fact that Board President Chiu had introduced an amendment that only allows for a 41 ft. bridge across Yosemite Slough, thereby halving the width of the 82 ft. bridge that Lennar is proposing to build.

That amendment, which Chiu introduced July 12,  leaves the door open for the 82 ft. version of the bridge, if the 49ers indicate interest in a new stadium on Hunters Point Shipyard, a possibility the city claims is still alive, even though Santa Clara voters approved a new stadium for the 49ers this June.

“So, why can you amend the plan to include a scaled-down version of the bridge but not eliminate it altogether?” Campos asked.

“You can make that motion by voting not to approve the project,” Sullivan said.

“So, the change has to point to something already embedded in the project?” Campos asked.

“Or not be a rejection of everything that’s already been brought forward,” Sullivan replied.

After Mirkarimi proposed his no-bridge alternative, along with a slew of other amendments that Daly, Campos, and Sups. Eric Mar and John Avalos had been working on to strengthen the proposed development, Cohen, Mayor Gavin Newsom’s top economic advisor, huddled somewhere in City Hall along with Kofi Bonner,  Lennar’s top local executive and Fred Blackwell, the head of SF’s Redevelopment Agency to decide which of the Board’s amendments they would accept.

Cohen returned with the amendments organized into three categories: acceptable as written, modified, and completely unacceptable.

And predictably enough (to anyone  tracking Lennar’s insistence on a bridge) Mirkarimi’s no-bridge amendment had been tossed into the “unacceptable” pile.

“Yes, but I’m still trying to look for the information, and all I’m hearing is this pitch,” Mirkarimi replied. “The economic study is absent. There are no supporting documents here. This is why I feel it’s justified for use to have a review of this.”

Cohen talked some more about “rigorous public discussion over a number of years.”

“But there is no economic study,” Mirkarimi repeated. At which point a deafening silence pervaded the Board’s venerable chambers, much as if the emperor had shown up without his proverbial clothes.

Deputy City Attorney Sullivan broke the silence by indicating that the only way for the Board to move a no-bridge alternative forward would be to stop all project approvals and send the plan back to Redevelopment.

And Mirkarimi reminded the supervisors that at the Board’s July 13 hearing, Cohen had said that there was no conclusive evidence around the need for the bridge.

But then the Board voted 6-5 against Mirkarimi’s proposal, a move insiders said was more about not pissing off Labor, which hopes to create jobs for iron workers, and not pissing off Lennar, whose control runs deep and wide, and less about being convinced of the actual need to build over the last unbridged waterway in the city’s southeast sector.

And a couple of amendments later, the Board gave its blessing and it was all kisses and hugs and applause in the Board Chambers, even though the folks from Dwayne Jones Communities of Opportunities (COO) program, who usually show up to support the plan, strangely weren’t in attendance, rumoredly because their program has been cut off at the knees in the last few weeks, following Jones resignation as COO’s director.

“I wish we had been able to eliminate the bridge,” Campos told me after the Board’s final vote. “I think part of the challenge we have is to reexamine how Redevelopment works and explore the potential for taking it over.”

Mirkarimi was satisfied that he had dissected the arguments against the no-bridge alternative, but feared that institutional memory is lacking on the Board, and that without fundamental Redevelopment reform, the city is in danger of seeing this kind of travesty repeated, over and over.

“A lot of my colleagues have not been involved in the debacle,” Mirkarimo said, referring to how Redevelopment’s infamous role dates back five decades, and how Lennar has been working the local political scene for longer than most of the Board’s current members.

But Maxwell was all smiles.
“I did my homework a long time ago, that’s why they couldn’t touch the core of the project,” she said. “They just added to and augmented it.”

With Maxwell’s days on the Board drawing to a close, I asked what she’s contemplating doing next.

“Sophie is looking into water policies and conservation,” Maxwell said. “Without blue there is no green.

It was about then that Mayor Gavin Newsom released a press statement that blabbed on in vaguely frothing terms about what would happen next.

“Now we can truly begin the work of transforming an environmental blight into a new center of thousands of permanent and construction jobs, green technology investment, affordable housing and parks for our City,” Newsom said

His words came shortly before Bonner said that Lennar would now start looking for investors, and shortly after Cohen admitted that it could be years before anything in Lennar’s plan actually gets built. But none of them mentioned that the Sierra Club and other environmental groups are planning to sue the City over the bridge, an outcome that could have been averted, Sierra Club officials warned, if the No-bridge alternative had been  included in the final redevelopment plan.

“The thing I love most in life is being a grandmother for social change.”

“If you mess up, you fess up — and then you fix it up.” That’s one of the motivational philosophies Sharen Hewitt, founder and executive director of the Community Leadership Academy and Emergency Response Project (CLAER) passes on to the people she works with. Her organization provides peer-to-peer empowerment and civic engagement programs as well as immediate crisis stabilization for victims of violence, helping them get the support they need. CLAER is based in Bayview, “but we serve the whole city, which unfortunately needs us more than ever,” she says.

A community leader and organizer for decades, Hewitt has been a critical and unyielding voice on housing, voter registration, education, employment, and political access issues. Her current focus has been on easing recent tensions between the African American and Asian American communities, weeding through the crowded field of candidates running for District 10 supervisor, and “insuring continuing dialogue about the development of sound public policy in the face of diminishing resources.”

“We celebrate diversity, and we try to raise the bar every day,” she says of CLAER. “San Francisco is the richest city in the richest state in the richest country in the world. It should be unlimited in its capacity to serve.”

ISO RABINS

“My favorite thing about the Bay Area is the coast along Route 1. It consistently amazes me.”

Food revolutionary Iso Rabins has organized the most intriguing — and fun — food events of the last year, expanding his health code-defying Underground Market far beyond its original berth in a Mission District home. But his keystone contribution to the Bay Area is his ability to communicate his vision of feeding communities without the agro-industrial machine — by recognizing the soil-generated bounty available to all of us if we know where to look.

“The way our society is structured right now didn’t seem like it paid attention to our local community. I think food is a great way to break through that,” Rabins says. His brainchild is forageSF, an organization that promotes hunting and gathering through wild food walks, eight-course foraged meals, and retail opportunities for foragers who spend days picking through the woods, fields, and coastlines. In the locavore-freegan vein, Rabins calls attention to a world beyond shrink-wrap and leaden government regulations. And his message is being eaten up by change-hungry SF. “I really think you can do business and help people at the same time,” he says.

KATHERINE PRIORE

“Something I love about San Francisco is being able to take yoga classes with the best teachers from here to Timbuktu.”

Eleven years ago Katherine Priore was an English teacher in Cincinnati’s public school system. After a particularly stressful day in the classroom, she finally took a close friend’s advice by attending said friend’s yoga class. Priore was instantly hooked. “I had never experienced such profound internal stillness. My stress was alleviated and the stream of anxious, teaching-related thoughts vanished in those 90 minutes.” It was this eureka moment that set Priore on the path to creating Headstand, an organization providing youth in economically disadvantaged areas with access to yoga.

The organization’s ultimate goal is to create a shift in the education system whereby the physical, emotional, and psychological health of students has the same importance as the academic skills they’re building. Headstand aims to do its part by integrating yoga into the curriculum, not just as an elective but as a requirement. Over the past two years, the organization has offered 1,400 yoga classes to 660 youths in the East Bay and San Francisco, and this fall it plans to bring Headstand to San Jose and Houston. With a slew of evidence that Headstand is positively affecting the lives of its students, all signs point to the early success of the program and to the potential it may just be starting to fulfill.

ERICA MCMATH SHEPPARD

“I love the Youth Speaks office. It doesn’t matter what I’m wearing or what I look like there.”

Odds were against Erica McMath Sheppard to be onstage at the Warfield this past March receiving thunderous applause from a sold-out crowd. But as McMath Sheppard’s powerful championship Youth Speaks Teen Poetry Slam spoken word performance put it, “I been helping myself my whole damn life .” Two things were clear under those bright lights: this woman has a story to tell, and the world’s going to hear it — no matter a difficult childhood, a disastrous trek through the foster care system, and eventual emancipation from her guardians at age 16.

In addition to her poetry laurels and longtime involvement with the Youth Speaks arts program, the Class of ’10 Leadership High graduate was senior class president, involved in the Black Student Union, and active in a slew of other extracurriculars — a record that earned her admission to Dillard University in New Orleans this fall. Does she consider herself a role model? “I’m not trying to be the voice for foster girls around the world,” she says. “But this is my dream.”

DONNA SACHET


“It’s not always easy to live in San Francisco — but it sure is a hell of a lot of fun.”

A constant presence on the queer and charitable scenes for years, Donna Sachet will go to any lengths to call attention to worthy causes — including rappelling down 38 stories of the Grand Hyatt San Francisco to raise money for the Special Olympics.

As a performer and sparkling personality, Sachet MCs the popular Sunday’s a Drag weekly brunch spectacular at Harry Denton’s Starlight Room, hosts the live coverage of the Pride parade on television, writes a society column for The Bay Area Reporter, and attends pretty much every charitable event worth attending. (You can always spot her by her impeccably tailored red outfits — she is, after all, Scarlet Empress XXX of San Francisco’s Imperial Court.) Her annual holiday Songs of the Season event and Pride Brunch fundraiser, along with her involvement with the Bare Chest Calendar benefiting the AIDS Emergency Fund, have raised thousands of needed dollars.

“You just have to do it,” she tells us of her unflagging energy. “I love my community. But even if it’s not particularly about your own community, we’re all in this together.”

VERNON DAVIS

“When I paint, I focus completely on what I’m doing and everything else fades.”

Freshly minted Pro Bowl superstar Vernon Davis has shown immense prowess on the football field since being drafted by the San Francisco 49ers in 2006. His career is on the upswing, and last season he tied the NFL all-time record for most touchdowns as a tight end. Davis’ success is the product of natural talent combined with drive and vision. He grew up in inner-city Washington, D.C., where a wise grandmother helped him dodge the environment’s potential pitfalls.

That same talent, drive, and vision extend beyond the goal posts into more esoteric realms. He’s an avid painter and seeks to be a role model for kids who might be afraid to explore their creativity. Earlier this year he launched the Vernon Davis Scholarship Fund, which will benefit a deserving Bay Area art student who would otherwise not be able to afford college. “I want to keep encouraging kids, especially in the inner city, to stay on track and pursue their dreams.”

JANE MARTIN


“I love being around a really vibrant queer and progressive community.”

On March 8, labor activist Jane Martin helped organize a flash mob in the crowded lobby of San Francisco’s Westin St. Francis Hotel. The purpose was to spread the word about a worker-called boycott of the hotel and urge tourists coming in for Pride to stay elsewhere. For five raucous and entertaining minutes, members of Pride at Work/HAVOQ, One Struggle One Fight, and the Brass Liberation Orchestra burst through the doors to sing, play, and dance to Lady Gaga’s hit “Bad Romance,” warning bewildered patrons not to “get caught in a bad hotel.”

The result: A collaborative effort of young and innovative labor leaders like Martin became a viral YouTube sensation, reaching hundreds of thousands of viewers. Martin has been joining with hotel workers in picket lines and organizing around queer economic justice issues in the Bay Area since 2001. She led picket lines at the Omni Hotel to decry the company’s move of locking out thousands of workers. “To ultimately win was really exciting,” she said. “When the hotels backed off, that was really inspiring.”

She recently joined 1,000 in staging a protest at the home of GOP gubernatorial candidate Meg Whitman as part of her organizing work with the California Nurses Association. And, as always with Martin, there’s more in the works.

DAVID CAMPOS


“The Bay Area embodies the American spirit more than anyplace else in the country. You can be who you are without any fear.”

San Francisco is a city of immigrants, a place where generations of people have come — from all over the country and all over the world — for a fresh start in a welcoming environment. But Mayor Gavin Newsom put that tradition at risk this year when he directed law enforcement agents to start referring juveniles charged with crimes to federal immigration authorities. It’s been a disaster — in one case, a 13-year-old charged with stealing 46 cents was turned over to the feds, and he and his mom, who is married to a U.S. citizen, both faced deportation, breaking up a family.

San Francisco Sup. David Campos has led the battle to protect the city’s sanctuary policy — and has taken on the larger issue of immigration reform. An immigrant who arrived in the United States from Guatemala at 14 (and who couldn’t get federal financial aid to go to college because of his status), Campos isn’t afraid to challenge the growing nativist movement: “What’s made this country great,” he told us, “is taking talent from all over the world and integrating it into society. Now the current climate precludes that.”

The bridge isn’t the only problem with Lennar’s plan

I’m glad to see the New York Times circle back to the Candlestick-Shipyard development with an article that was a tad more critical than their previous piece.

But while I enjoyed NYT’s joke about how the proposed bridge over the Yosemite Slough “has become a 950-foot-long chicken bone that keeps getting stuck in San Francisco politicians’ throats,”  I’m afraid the Board is in greater danger of choking on the bones of red herrings that they have been fed about this project,  along with last week’s bombshell that the Board won’t be able to amend Lennar’s plan, after all, when it votes July 27 on this massive proposal..

D. 10 candidate Tony Kelly says if that bombshell turns out to be true, it’ll be another example of what he calls, “The bait and switch and switch,” on the deal.

“I’m worried that the Board is getting advice that is less about a case of not being able to vote, and more a case of, if you vote, you could open up the city to liability,” Kelly said.

“Back in 2008, folks were told, just vote for Prop. G because it’s just a concept and we’ll have a robust conversation about the plan itself, but they’ve been running away from that promise ever since,” Kelly explained. “And during the EIR hearings, we were told that folks were simply approving the environmental impact report, not the plan itself.”

Kelly’s critiques of Lennar’s plan and the process by which it has been winning final approvals helped him win former Board President Matt Gonzalez’s endorsement last week in the pivotal race to replace termed-out D. 10 Sup. Sophie Maxwell.

But Kelly worries about the fallout that the next D. 10 supervisor will be left to mop up, if the Board goes ahead and approves Lennar’s plan, as is.
 
“What I’d dread to see happen is that this plan get bullied through on an up and down vote, and then a fifth, or even a tenth of people’s concerns prove to be true, and the next D. 10 supervisor spends the next 4-8 years apologizing to the people of the Bayview, because they won’t be able to do anything else for the area, and this plan keeps lumbering along and doesn’t even work,” Kelly explained.

He says he wants to know who can amend the plan, if it’s not the Board and when.

“ My concern is that after the July 27 vote, the city and Lennar will never have to come before the Board again,” Kelly said, pointing to the uncritical endorsement of the project EIR that the Planning and Redevelopment Commissions, the lead agencies on the plan, made June 3, and who would likely be tasked with any additional studies and findings.

Sup. Ross Mirkarimi confirmed today that the Board has been told that it has limited reach because of Redevelopment law, which supercedes municipal law.”
“But, nonetheless, I’m going to try to make some amendments,” Mirkarimi said.

He noted that the five amendments that Board President David Chiu introduced July 12 during a Land Use Committee hearing were “very benign.”

‘They mostly restated what was already in the project agreement or project EIR,” Mirkarimi said. “So, they don’t amend much, because they are statements of what has already been evaluated or pre-agreed to by Lennar and the city. And they are very benign because they do not require any changes to the plan.”

Mirkarimi observes that the current process by which the city is trying to push this deal through is designed to lock the Board out.

“There are larger questions in play here about our relationship with the Redevelopment Agency and redevelopment law,” Mirkarimi continued. He notes that San Francisco is one of only a few counties in California where the Board is not the same entity as the Redevelopment Agency.

“It’s long overdue that we return to the idea of having the Board have authority over the Redevelopment Agency, it’s been a problem for 40 years,” Mirkarimi said,  referring to Redevelopment’s disastrous handling of the Fillmore, which resulted in the massive and mostly permanent displacement of the Western Addition’s African American community—a negative consequence that many fear will be repeated by the plan for Candlestick-Hunters Point.

“There is a real capitalization on a starving population which is desirous of and at times desperate for positive changes and for jobs and housing, which is understandable,” Mirkarimi continued. “But absent of any alternative, it’s logical that this plan would move forward.”

In an effort to improve the plan, Mirkarimi says he will try to introduce a range of amendments at the Board’s July 27 meeting.

‘These include an attempt to make sure that whatever changes the Board makes are indeed enforceable,” he said. “And I am not satisfied with the discussion on the bridge, and how the gate has been left open on a bridge of any kind.”

Mirkarimi notes that there has been a lot of fanfare surrounding a community benefits agreement that various community-based organizations, labor and the project proponents entered into, in spring 2008.

“But I think they can do better, especially in reaching out to a community that has a high ex-offender population, and connecting to other disadvantaged communities throughout the city,” Mirkarimi said.

He also wants to ensure that if public power is not implemented, or fails, then Community Choice Aggregation program would automaticcally take over.

Mirkarimi is further concerned that there is nothing in the current plan that defines the percentages of housing units offered for rental and for home ownership.

“We are proposing to build 10,500 units but we have no idea what percentage is rental,” he said, noting that he also has concerns about air quality, air monitoring and parcels of land that have not yet been cleaned up to residential standards.

“Parcel E-2 is the most famous, but it’s not the only one,” he said. “The bridge and Parcel  E-2 have become major distractions in that they have sucked the oxygen out of other areas of these gargantuan project.”

So, is it true that elected officials on the Board can’t amend a plan sent to them by the Redevelopment Agency, whose commissioners are all political appointees of the mayor?

“It’s a yes or no vote, if you will,” a deputy City Attorney told the Guardian, on background, noting that the Board could tell Redevelopment that it doesn’t like the plan and wants the Agency to make some changes and bring it some amendments.

“Ultimately, the Board has the final say, but it has to have gone through the Redevelopment process and its PAC (project area committee) and have seen a plan that has been referred to it by the Planning Commission,” the deputy city attorney continued.“So, they could communicate their dissatisfaction and the agency would have to take their view into account. It’s not that the Board has no authority, but it can’t decide unilaterally.”

The City Attorney’s Office also confirmed that under Redevelopment Law, local jurisdictions can decide how to implement redevelopment plans.

“In a number of jurisdictions, the city council has made itself a Redevelopment entity, just as our Board is also the Transportation Authority in San Francisco,” the deputy said.“And if the same body proposes the plan, it probably will be satisfied.”

The City Attorney’s office noted that if agencies that regulate permits to fill the Bay, as is  required to build a bridge over Yosemite Slough, deny the city those permits, then the city would require amendments to its planning documents, but no further environmental impact review would be required, if the bridge was gone.

With the Board’s July 27 vote around the corner, D. 10 candidate Tony Kelly says he has a bunch of concerns that include, but are not limited to the bridge, starting with the projects financing mechanisms.

Kelly points to the fact that city staff recommended and the Board approved July 13 that “significant blight in the project area cannot be eliminated without the increase in the amount of bonded indebtedness from $221 million to $900 million and the increase in the limitation on the number of dollars to be allocated to the Agency from $881 million to $4.2 billion.”
 

Kelly wants the city to explain to the Board how much tax increment financing money will be left for the Bayview, now that the area’s debt ceiling has been tripled.

“Does this mean that all BVHP property tax revenues for the next 30 years will go towards paying down this debt and nothing else?” Kelly asked. “And what will that mean for the rest of BVHP in terms of service and programs it won’t be able to afford?

Kelly would also like to see the Board request an audit of Lennar’s record on Parcel A. As Kelly points out, the Navy conveyed Parcel to the city in 2004, and the city gave Lennar the green light to develop 1,600 mostly luxury condos on that parcel, in 2006.

“But no one has ever done an audit of Parcel A,” Kelly said. “Given the scrutiny that the Board usually brings to five figure numbers, the supervisors should be demanding this information, since we are dealing with a ten-figure number ($4,220,000,000) in future.”

It would be helpful if the City would also brief the Board as to who it believes will be investing in the project,  including the investment companies’ names,  their board of directors, and whether these companies are based in the US. Rumors are swirling that some project proponents have entered into side-deals that involve limited liability companies that are selling Lennar’s proposed condos to folks in China, and that a $1 million investment in a condo could translate into a work permit for the condo owner or occupant.

Kelly worries that the city and Lennar’s joint redevelopment plan is being allowed to squeak past the Board’s financial review simply on the basis of vague estimates.
“They rely once again on promises that won’t show up,” Kelly said, pointing to a recent report that emerged from the Controller’s Office.

Arc Ecology’s Saul Bloom notes that the Controller used averaged figures in that report, an approach that neatly obscures the fact that many of the project’s alleged and benefits– will not be created or felt for years. Bloom for his part is hoping the Board can introduce a maritime uses amendment. This would allow relatively unskilled jobs to be created at the shipyard in short order, compared to vague promises of  building a green tech office park there, some day.

Last week, Mayor Gavin Newsom’s top economic advisor Michael Cohen suggested that plan amendments would delay project construction.

But Cohen was quick to add that, “702 acres of waterfront land in San Francisco is an irreplaceable asset. It’s not a question of if—but when—it gets developed.”

Others are less sure that Cohen’s much promoted vision will ever translate into reality.

So, here’s hoping the Board will grill Cohen and city staff over the financial details, including the internal rate of return (IRR) that Lennar is demanding, and what will happen to promised community benefits, if the IRR doesn’t pencil out. D. 10 candidates DeWitt Lacy, Chris Jackson and Tony Kelly have suggested that some form of liquidated damages  are needed, but if the City believes these are unnecessary, it should explain why.

And then there are questions about the impact on air quality of the traffic related to an additional 24,500 residents and 10,000 workers into the city’s southeast.

Personally, I was fascinated by an April 2010 report from the Redevelopment Agency in which the agency discussed the challenges of driving piles through contaminated soil, which is what could happen if a bridge is built over the Yosemite Slough. In the past, the city made the argument that the NFL and the 49ers were requiring this bridge.

But last week, in the wake of Santa Clara’s vote in favor of a new stadium for the 49ers near Great America, the city began arguing that the bridge would make the project more attractive to financers, because employers want to get their employees quickly in and out.

This was the first time I ever heard city staff make that particular argument and they made it when it’s still not clear who these employers even are.

 So, let’s flesh out the list of potential employers, so the Board can determine if design decisions are being made in the interest of the local community or out-of-state businesses.

And then there’s the fact that it appears that this proposed $100 million bridge would only save commuters a few minutes, while permanently filling the San Francisco Bay.

Today, the Sierra Club, the Golden Gate Audobon Society, the California Native Plant Society and San Francisco Tomorrow released a report that asserts that the Candlestick Point-Hunters Point Shipyard EIR “misrepresents the need for a bridge.”

“A statistical review demonstrates that a route around Yosemite Slough could be as efficient as a bridge route while being better for the environment,” stated a letter that the Sierra Club-led environmental coalition released today. “It’s time for the Board of Supervisors to reject the bridge alternative and insist that the feasible upland route around Yosemite Slough be seriously considered.”

The letter argues that a regression model result found in the Transportation Study Appendix F of the Candlestick Point-Hunters Point Phase 11 EIR provides “no statistically significant evidence to support the claim that a 5 minute increase in transit travel time would lead to a 15 percent decrease in transit ridership, or, indeed, to any decrease in ridership.”

“Therefore, routing the BRT around Yosemite Slough is as consistent with a transit-first redevelopment goal as a bridge alternative, but without the environmental damage wrought by the bridge,” the Sierra Club-led report states in summary. “The results of the regression analysis used in the EIR and relied upon to support the bridge alternative have been misinterpreted in such a way that even if they were statistically significant they are off by a factor of ten: the decrease in transit ridership associated with 5 extra minutes of transit time would be predicted to be approximately 1.5 percent, not 15 percent,” it concludes.

“When the analysis [presented in the Sierra Club’s letter] is combined with previous analyses by LSA Associates (which estimate the increase in travel time would be approximately 2 minutes, rather than the 5 minutes in the final EIR) and other available information, one must reach the conclusion that the FEIR misrepresents the effect on travel time and ridership that would result from a route around Yosemite Slough. Overall, it poses further questions about the need for a bridge over San Francisco’s largest wetland restoration project.”

The Sierra Club-led report lands two weeks after Board President David Chiu introduced his July 12 package of amendments which seeks to narrow the bridge, not eliminate it, and require the Board to hold hearings before the Navy transfers Parcel E-2 to the city.

It’s a good idea for the Board to require hearings before E-2 is transferred to the city. But does this mean the Board will be able to direct the Navy, when it’s time to decide whether to cap or excavate the contamination in that parcel? The answer appears to be no. All the Board can do is to reject the Navy’s proposed solution.

But how would this work? What would happen then? And Parcel E-2 isn’t the only parcel on the shipyard where seriously nasty stuff has been found and is still be cleaned up.

The good news is that at this point, the project still doesn’t belong to the Board.

The bad news is that, as of tomorrow, it could belong to them, if the supervisors opt to approve Lennar’s plan with a simple up-down vote. And given the rush and the political pressure that the process has been subjected to since 2006, it’s almost certain that some scandal will engulf the project, some time in the future. And this Board of Supervisors’ names will be on it. Even if nothing ever gets built at the shipyard.

“How can the city say nothing will be built for years, because we have promised so much, when they say out of the other side of their mouth, that the only way that we can make these promises to the community, is if the community supports the plan?” Kelly asks. “On what planet do we think this makes sense? I think we are moving out of the solar system with every passing week.”

There’s no crime in members of the Board admitting tomorrow that they have not read the entire plan and don’t understand all the details. As the folks in Alameda humbly admitted last week, when they kicked out developer SunCal, it took them years to understand what was being proposed—including the fact that the project might leave their city in the hole, financially.

But it would be a crime for the San Francisco Board of Supervisors to vote yes on this massive proposal without first having done that homework. Yes, I’ve heard supervisors say in the past they are deferring to Sup. Maxwell, since the project lies in her district. But Maxwell is termed out, and the project will impact all of the city, especially in terms of its ethnic and economic diversity, in future. So, as we’ve said, buyer beware!

Lennar Corp.’s massive redevelopment plan for Candlestick Point-Hunters Point cleared a critical hurdle July 14 when the Board of Supervisors voted 8-3 to affirm the Planning Commission’s certification of the project’s final environmental impact report, with Sups. John Avalos, Chris Daly, and Eric Mar opposed

Board President David Chiu called the vote "a milestone." Termed-out Sup. Sophie Maxwell, whose District 10 includes Candlestick Point and the former Hunters Point Naval Shipyard, saw the vote as evidence that city leaders support the ambitious plan. Yet many political observers saw the vote as proof that Lennar and its Labor Council allies have succeeded in lobbying supervisors not to support opponents of the project.

"I’m concentrating on pushing this over the finish line," Maxwell said at the hearing in the wake of the vote, which came in the wee hours of July 14 after a 10-hour hearing. Supervisors can still amend Lennar’s development plan during a July 27 hearing and project opponents are hoping for significant changes.

Mar said he wants to focus on guaranteeing that the city has the authority to hold Lennar responsible for its promises. "I want to make sure that we have the strongest enforcement we can," he said.

Lennar’s plan continues to face stiff opposition from the Sierra Club, the Golden Gate Audubon Society, the California Native Plant Society, San Francisco Tomorrow, POWER (People Organized To Win Employment Rights) and CARE (Californians for Renewable Energy).

Representatives for these groups, whose appeals of the EIR certification were denied by the board, say they are now weighing their options. Those include taking legal action within 30 days of the board’s second reading of and final action on the developer’s final redevelopment plan, which will be Aug. 3 at the earliest.

Supervisors are expected to introduce a slew of amendments July 27, when they consider the details of the proposal and its impacts on the economically depressed and environmentally polluted.

Michael Cohen, Mayor Gavin Newsom’s top economic advisor, admitted July 19 that all these various demands will likely delay project construction. "But 702 acres of waterfront land in San Francisco is an irreplaceable asset," Cohen reportedly told the San Francisco Chronicle. "It’s not a question of if — but when — it gets developed."

Chiu already has introduced five amendments to the plan in an effort to alleviate concerns about shipyard toxins, Lennar’s limited financial liability, a proposed bridge over Yosemite Slough, and the possibility that local residents will need more access to healthcare and training if they are to truly benefit from the development plan.

Sup. Ross Mirkarimi told the Guardian that he expects the board will require liquidated damages to ensure the city has some redress if the developer fails to deliver on a historic community benefits agreement that labor groups signed when Lennar was trying to shore up community support for Proposition G, the conceptual project plan voters approved in June 2008.

Mirkarimi said the board would also seek to increase workforce development benefits. "Thirty percent of the target workforce population are ex offenders. So while they might get training, currently they won’t get jobs other than construction," Mirkarimi observed.

He supports the health care access amendment and the public power amendment Chiu introduced July 21, pointing to Mirkarimi’s previous ordinance laying the groundwork for public power in the area. "This ordinance established that where feasible, the City shall be the electricity provider for new City developments, including military bases and development projects," Mirkarimi said. "PG&E was ripped when we pushed that through."

But Sierra Club activist Arthur Feinstein isn’t sure if additional amendments will help, given intense lobbying by city officials and a developer intent on winning project approvals this summer before a new board and mayor are elected this fall.

"Chiu’s amendments gave us what we asked for over Parcel E-2" Feinstein said, referring to a severely contaminated section of the shipyard for which Chiu wants an amendment calling for a board hearing on whether it’s clean enough to be accepted by the city and developed on.

But Feinstein is less than happy with Chiu’s Yosemite Slough amendment, which would limit a proposed bridge over it to a width of 41 feet and only allow bike, pedestrian, and transit use unless the 49ers elect to build a new stadium on the shipyard. In that case, the project would include a wider bridge to accommodate game-day traffic.

"The average lane size is 14 feet, so that’s a three-lane bridge. So it’s still pretty big. And it would end up filling almost an acre of the bay," Feinstein said.

Feinstein thanked Mirkarimi and Campos for asking questions that showed that the argument for the bridge has not been made. "But it’s disappointing that a progressive Board would be willing to fill the Bay for no reason," Feinstein said.

He concurred with the testimony of Louisiana-based environmental scientist Wilma Subra and environmental and human rights activist Monique Harden, who challenged the wisdom of the Navy digging out toxins while the developer installs infrastructure at the same site.

Subra said contamination is often found at Superfund sites after they have been declared clean when contractors to later dig into capped sites and expose workers and the community to contamination. Harden said the plan to begin construction on some shipyard parcels while the Navy removes radiological-contamination from shipyard sewers is "like a person jumping up and down on a bed that another person is trying to make."

But Cohen, who has aggressively pushed the project on Newsom’s behalf, countered that there is no scientific evidence to support such concerns. "It’s a very common situation," Cohen said. "It’s the basis for shipyard artists and the police being on the site for many years … It’s safe based on an extraordinary amount of data."

But Feinstein pointed to his experience working for the Golden Gate Audubon Society at the former Alameda Naval Station. He recalls how a remediation study was completed, but then an oil spill occurred at the site, which had been designated as a wildlife refuge.

"The military didn’t know about everything that happened and was stored on site, and it’s easy to miss a hot spot," he said. "And who’ll be monitoring when all these homes are built with deeds that restrict the renters and owners from digging in their backyards?"

Feinstein said he’s concerned that only Campos seemed to be asking questions and making specific requests for information around the proposed project’s financing

"Lennar is paying city staff and consultants and promising labor huge numbers of jobs. When you are throwing that much money around, it’s hard for people to resist — and the city has been co-opted," Feinstein said. "And how much analysis and resistance can you expect from city commissions when the Mayor’s Office is the driving force behind the project? So we don’t have a stringent review. The weakness of the strategy of ignoring our bridge concerns is that when we sue, we may raise a whole bunch of issues."

Arc Ecology director Saul Bloom says Chiu’s bridge proposal "screwed up the dialogue. We were close to a deal," Bloom claims. "But while that amendment allowed one board member to showboat, it prevented the problem from being solved."

Bloom is concerned that under the financing deal, the project won’t make any money for at least 15 years and will be vulnerable to penalties and bumps in the market — an equation that could lead the developer to build only market rate housing at the site.

"It’s a problematic analysis at best," he said.

"The bigger the development, the more it benefits people who have the capacity to address it — and that’s not the community," Bloom said. "So there’ll be more discussion of the bridge, and that’s where the horse-trading is going to be."

He also said the bridge has now taken on a symbolic value. "The thing about the bridge is that it’s not actually about the bridge any more," Bloom added. "It’s about Lennar telling people, ‘You will support us.’ If they get the bridge, it will give them free rein, an unencumbered capacity to do as they see fit. They are willing to make deals, but they have to have the bridge because it defeats the people who have been the most credible and visible — and then they have no opposition."

Board accepts EIR, but vows to amend Candlestick-Shipyard plan

At the end of a ten-hour hearing to appeal the final environmental impact report  for the city and Lennar’s massive Candlestick-Shipyard redevelopment project, the Board voted 8-3 to accept the FEIR, with only Sups. John Avalos, Chris Daly and Eric Mar voting to reverse certification of what they said was a flawed document.


But the vote does not mean the Board has voted to accept the city and the developer’s final redevelopment plan. That plan will come before the Board on July 27, and the supervisors are expected to introduce a slew of amendments, in addition to  five amendments that Board President David Chiu introduced earlier this week.


These amendments are intended to address longstanding concerns about toxins at the shipyard, limited liability on the part of the developer, the questionable need for a bridge over Yosemite Slough, the reality that Bayview residents may be cut out of any upcoming jobs, and the desire to nail down efforts to use public power at the site


“We can’t do the amendments here, we are frozen out, all we can do is an up and down vote on the EIR for now,” Sup. Ross Mirkarimi told the Guardian last night. 
Mirkarimi anticipates that the Board will seek additional mitigations, such as requiring liquidated damages to shore up a community benefits agreement that Labor entered into with Lennar in May 2008.


Mirkarimi said the Board would also seek to increase workforce development benefits.
“Thirty percent of the target workforce population are ex-offenders, so while they might get training, currently they won’t get jobs other than construction,” Mirkarimi observed.


Mirkarimi was proud of the Public Power amendment that Chiu has already lintroduced, pointing to an ordinance that he and then Sup. Gerardo Sandoval introduced and Mayor Gavin Newsom signed into law, in March 2006. This public power ordinance established that “where feasible, the City shall be the electricity provider for new City developments, including military bases and development projects.”


“PG& E was ripped when we pushed that through,” Mirkarimi said.


During yesterday’s marathon hearing, the supervisors grilled city staff on issues that have proved to be key sticking points, as the city seeks to win final project approvals, even though they cannot address these issues with amendments until the July 27 meeting.


The Board questioned the wisdom of moving forward with development on the Shipyard, as the Navy continues to clean up radiological contamination and other toxins at the site, including Parcel E-2, which contains some of the nastiest pollution at the yard.


“Why not just wait until the CERCLA process is completed?” Sup. Campos asked, referring to the fact that the Navy is responsible for shipyard clean up, under CERCLA, which is also known as the Superfund Act.


Campos question came after acclaimed environmental scientist Wilma Subra and national environmental human rights lawyer Monique Harden, challenged the sanity of having the Navy digging out toxins while a developer simultaneously installs infrastructure at the same site.


Subra, who works in Superfund sites throughout the U.S, warned the Board that it’s very common to find contamination at these sites after they have been declared clean.


“So, the number of samples isn’t the magic answer,” Subra said, referring to the city’s constant refrain that the Navy has taken thousands of samples at the site. Subra also warned that it is not uncommon for a contractor to dig into an area that has been capped, thereby potentially exposing workers and the community to contamination and resulting in legal stand-offs, as various parties argue as to who has responsibility to fix the resulting mess.


Harden, who is based in New Orleans but also has an office in D.C., expressed concern over the plan to begin construction on some shipyard parcels, even as the Navy continues to remove radiologically contaminated sewers and other deep infrastructure at the site.
“That’s like a person jumping up and down on a bed that another person is trying to make up,” Harden said


But Michael Cohen, Mayor Gavin Newsom’s chief economic advisor countered that there was no scientific evidence to support Subra or Harden’s concerns.


“It’s a very common situation, especially on brownfields,” Cohen said, (though the Shipyard is a Superfund site that’s been contaminated with radiological waste that was sandblasted off ships returning from a Bikini Atoll atomic testing experiment gone awry.)


“It’s the basis for shipyard artists and the police being on the site for many years,” Cohen continued. “It’s safe based on an extraordinary amount of data.”


But Cohen did agree that language in Chiu’s Parcel E-2 amendment should be changed from “should” to “shall” to indicate that city oversight is a requirement, not a request, when it comes to final decisions over the transfer of this particular parcel.


Mark Ripperda of U.S. EPA assured the Board that his agency is not going to permit transfer of parcels for development until cleanup is completed.
“We are not going to allow any transfer until we are convinced it’s safe,” Ripperda said.


Sup. Eric Mar chastised the EIR for its apparent failure to adequately discuss the impacts of the proposed development on schools in the surrounding area.


“There is less discussion of the impacts on schools than there is of the A-Bomb, which was held at the Shipyard for 1 to 2 days,” Mar said. “The analysis seems very weak.”


And Daly expressed frustration that the Board was being asked to take a decision when it lacked sufficient information about and understanding of the project.


“How do we know it’s safe? ” Daly asked, noting that, “Money talks, bullshit walks.”
(His point resonated as City staff scrambled to find key information within the 7,000 pages of comments and responses in the massive FEIR documents, and Amy Brownell of the city’s Public Health Department rattled off a series of measurements and schedules that few on the Board seemed to understand.)


“The risks are acceptable,” Brownell said. “And the only people allowed on the property [during the development] will be the ones doing the work.”


The Board also challenged the need for a bridge over the environmentally sensitive Yosemite Slough, especially in the wake of the June 2010 election in which Santa Clara voters approved building a new stadium for the 49ers near Great America.


“One reason I’ve been given for [the need for the bridge] is the financial viability of this project,” Campos said.


Cohen replied that if the city does not to build the bridge, “it elevates the financial risk.”


“Parcel C [on the shipyard] has been zoned for green tech, and for major employers, having that direct connectedness to BART and the T-Third is very important.”


Cohen also indicated that, thanks to the project’s huge reliance on tax increment financing, the loss of the bridge would translate into lost property tax revenues.


“Some of the repayment comes from generation of tax increment financing, so the failure to have a bridge here, degrades the potential of property tax revenues, and so you get much less tax increment,” Cohen stated.


The Board also expressed concerned that under the current terms of the deal they are now set to consider July 27, the developer has limited liability—an arrangement that has got supervisors worried that the city, and Bayview residents whose increased property taxes will help pay for the development, could end up on the wrong end of the financial hook.


Campos pointed to the disposition and development agreement (DDA) that the city drew up with Lennar.
“I’m specifically worried about a provision that on the face of it limits the developer’s liability,” Campos said, pointing to language that seems to say that “monetary damages are inappropriate”—conditions that Campos deemed, “Very unusual.


Cohen responded that the deal reflects the reality that, “the Navy, not Lennar is responsible for the cleanup.”
He added that the city retains the legal ability to sue, various remedies and, ultimately, “the right of reverter” (which folks call the “nuclear option” since it involves kicking out the developer, but losing everything in the process.)


“This is an incredibly frontloaded project,  in which we have the ability to terminate the developer at the cost of millions of dollars,” Cohen said.


But while the city and the developer ultimately affirm EIR certification, the decision left the Bayview community deeply divided, with many concerned that the FEIR failed to address their concerns, while others rejoiced, believing that they will benefit from jobs that will be created during the development’s 10-15 year build out and beyond. Only time will tell how it all plays out, but stay tuned as the Board prepares to try and make the plan the best it can in face of all these competing concerns.


 

Buyer beware of Candlestick-Shipyard project

Board President David Chiu has introduced five amendments to the city’s Candlestick Point-Hunters Point Shipyard redevelopment proposal. All five are a good start, but longtime observers question if they are too little, too late, in the face of intense lobbying by a city and a developer intent on getting project approvals before a new Board and possibly a new mayor occupy City Hall in January 2011.

Chiu’s amendments address key concerns with the city’s proposed redevelopment plan, and they come as the Board prepares for its July 13 hearing into three separate appeals of the project’s final EIR certification, as well as amendments to the Bayview Hunters Point and Shipyard redevelopment plans.

Two of Chiu’s amendments seek to address concerns about the clean-up of radiologically impacted waste at Parcel E-2 on the shipyard, and environmental impacts of a proposed bridge over Yosemite Slough.

Chiu’s other three amendments seek to finance the expansion of the Southeast Health Center, create a workforce development fund and analyze the feasibility of providing public power, including natural gas at the site.

But while all five amendments are welcome, some observers worry they do not fully address concerns about the project’s sustainability, financing and infrastructure.  But before we get to those concerns, let’s review Chiu’s five amendments in greater detail:

1. The Parcel E-2 amendment.
This amendment declares that the Board’s adoption of CEQA findings for the project “shall not in any way imply support of a cap for Parcel E-2.” 

As such, this amendment is a critical step towards insisting that the parcel get completely cleaned up, not just capped, as the Navy is currently proposing. On the other hand, it’s not a watertight demand to excavate and haul away all contamination from this parcel, which is the cleanup alternative that many in the community would prefer..

Instead, Chiu’s Parcel E-2 amendment declares that the U.S. EPA, California EPA and the Navy, “should pursue the highest practicable level of cleanup for Parcel E-2.”
And that the San Francisco Redevelopment Agency “should not accept the property unless and until that cleanup is satisfied.”

It also establishes that the Board shall conduct a hearing regarding final cleanup strategies for Parcel E-2 before a final remedy is selected, urges the U.S. EPA, California EPA and the Navy to participate in such a hearing, and further establishes that the Board shall conduct a separate hearing prior to any transfer of Parcel E-2 to Redevelopment.”

(There was some question as to why the Board was saying “should” in some parts of this amendment, and “shall” in others. The reason I heard was, you can’t force the Navy to do anything, but you can urge them, and you certainly can refuse to accept the property, if it is not cleaned up a city’s requirements.But this needs to be clarified.)

2. The Yosemite Slough Bridge amendment
Chiu notes that the city’s EIR for the project analyzed a non-49ers-stadium alternative that “includes an approximately 41 ft. wide bridge spanning the Yosemite Slough which is limited to bike, pedestrian and transit use.”
“However, in the event the San Francisco 49ers elect to build a new stadium on the shipyard site, the project will include a bridge spanning Yosemite Slough that is wider than 41 ft. across to accommodate game-day traffic,” Chiu’s amendment states.
(So, Chiu’s amendment doesn’t throw the bridge entirely out with the 49ers’ stadium, and that leaves environmental groups uneasy, afraid that the anticipated 25,000 new residents in the proposed development will subsequently push for legislation to allow for a wider, car-accessible bridge.)

3. The Southeast Health Center amendment
Chiu’s Southeast Health Center amendment demands that the developer contribute $250,000 to the Redevelopment Agency for a needs assessment study regarding the need to expand the center and the ongoing health needs of local residents, and, to the extent such expansion is needed, to help pay for predevelopment expenses associated with this expansion.
The capital costs for expanding the center would be funded through a combination of  tax increment dollars, a $2 million Wellness Contribution paid by the developer, and the City’s ability to finance savings that would accrue to the Department of Public Health by moving from leased space into owned space at the expanded center.

4. The Workforce Development Fund amendment
Chiu’s amendment would modify language in the current community benefits agreement to require the developer to contribute $8,925,000 to a workforce development fund to be used for programs “designed to create a gateway to career development, fiirst for residents of District 10 and secondly for “at-risk job applicants.”
(A member of the public suggested that veterans be specified as “at-risk job applicants,” an idea D. 10 Sup. Sophie Maxwell seemed to support during yesterday’s July 12 Land Use Committee hearing, which was where Chiu introduced his five proposed amendments.)

 5. The Public Power amendment 
Chiu’s public power amendment notes that the SFPUC confirmed the feasibility of providing electric service to the shipyard sire, but requires the agency to update this study and include the Candlestick site and include “an analysis of the feasibility of providing natural gas to the project site.”

But will these steps be enough to ensure that the development actually delivers on its promises of thousands of jobs, and hundreds of affordable housing units,? And is a bridge really necessary across Yosemite Slough, if the 49ers go to Santa Clara as planned?

Long-term observers of the project point to the first phase of the project, which began on the shipyard’s Parcel A, as a warning of where things might end up.

“We approved the fast-tracking of Parcel A based on a bevy of assurances and enthusiastic endorsements from the best and brightest this administration has to offer,” said a source who wishes to remain anonymous. “But what has happened since then, and what are we to learn from this experimental test case?”

This source noted that recent maps of the shipyard show that Parcel A, which the Navy conveyed to the city in 2004, has since been carved up into several new pieces.

“How did Parcel A get divided into two areas that don’t even border one another?” my source asked.

The answer appears to be that sections of the shipyard, including Parcel A,  have since been renamed as new and separate parcels, after it was discovered that shipyard sewers on those parcels contained radiologically contaminated material.

One of these sewer lines, as indicated on recent project maps, leads from a site now known as Parcel UC-3, into the Bayview. In other words, it appears to lead off the shipyard site and into the surrounding community. If so, this raises concerns that shipyard contamination is no longer limited to the shipyard in the Bayview, and could be impacting residents and businesses that are not covered by the Navy’s clean-up commitments.

Either way, it seems that the Board could use an update on what happened on Parcel A, since it was conveyed, what’s the deal with UC-3, and other recently renamed parcels, before they consider an early transfer of the rest of the shipyard.

“How can we start Phase 2 of the project, when we haven’t completed Phase 1?” my source asked.

And since the Navy is still tasked with cleaning up the rest of the shipyard parcels, it would be helpful if the Navy updated the Board on what the Navy is proposing in its Records of Decisions for each of these parcels, including UC-3, before the Board votes on Phase 2 of the project.

My source also noted that since the project plans to use 100 percent recycled water at the site, it would be helpful to have an update as to how issues with sewer contamination and groundwater concerns might impact the project’s sustainability plans.

“These issues touch on half of the documents that make up the EIR, but are now obsolete, because of the issue of radioactive contamination on UC-3,” my source claimed.

And then there’s the question of fproject financing and who the developer for the project actually is, these days.

“The city’s exclusive negotiating agreement (ENA) was with Lennar, so who is CP Development and why do we have an ENA with them?” my source asked.”What happened to Lennar? And why would we be obligated to negotiate solely with this CP Development group?”

Now, hopefully the Board has greatly reassuring answers to all these questions, so that the community can rest assured that the supervisors really do understand the ramifications of a project that they are being asked to approve in what appears to be an awful hurry.

Yes, there are plenty of project supporters who keep on urging “no delays.” I understand their concerns. They want jobs, housing, parks and other promised community benefits. And I don’t blame them.

But it’s up to the Board to ensure that it doesn’t get rushed into approving a project that perhaps doesn’t guarantee any or all of these things. So, let’s keep asking questions so the Board of Supervisors doesn’t end up with buyer’s remorse, but instead can truly claim to having secured a deal that really helps all the folks who currently live and work in the city’s southeast sector. D. 10 candidates DeWitt Lacy, Tony Kelly and progressive planners blast Lennar’s plan

Recently, I spent some time talking with D. 10 candidates DeWitt Lacy and Tony Kelly about Lennar’s redevelopment plan for the shipyard and Candlestick Point. I also attended a Progressive Planners forum that addressed the massive development proposal. Those conversations and the issues they raised seem timely in light of the city’s crazily tight schedule for trying to ram final approvals for the project past government agencies this summer. And in light of three appeals that have been filed against the city’s recently certified final environmental impact report for the plan, raising concerns that the city will get bogged down in expensive and time-consuming litigation if it doesn’t get the plan right, while it still can.

(Lest other D. 10 candidates complain that they weren’t interviewed, too, I’d like to clarify that I’ll be covering the race between now and November, and I look forward to hearing what they all think at the Board’s July 13 meeting to hear appeals of the city’s final environmental impact report (FEIR) for the project. )

Both Lacy and Kelly are critics of Lennar’s plan, but not in a knee-jerk obstructionist way. Instead, they bring considered and informed critiques to the table at a time when the community desperately needs good advice and a workable strategy, if residents are to get needed amendments and concessions, before the developer get the green light, or before the Board puts  a moratorium on the project until the city’s FEIR flaws are ironed out.

Lacy is a bright and earnest candidate who learned lessons from the school of life, while growing up in San Jose in a working class family. Lacy says his father worked in an Adidas warehouse until he was injured on the job, and his mother worked as a secretary in Atari’s corporate office, but was laid off after two years.

Lacy recalls how his parents opened their own janitorial business, in the hope of making a better life for their six children.  He says that it was while cleaning homes alongside his mother, that he began to recognize the need for working class improvement and growth.

 In 1995, Lacy moved to San Francisco, where he has worked in the District Attorney’s office and formed his own law practice—experience that could serve District 10 well, since it’s home to many working-class residents and will be ground zero in the battle for construction-related contracts and environmental and economic justice, if Lennar’s massive redevelopment plan goes ahead,

“I know how to craft legislation for social justice,” Lacy said.

Lacy observes how Michael Cohen, Gavin Newsom’s top economic advisor in the Mayor’s Office of Economic and Workforce Development, has repeatedly told folks that land transferred to Lennar will be subject to a “right of reverter.”
This means the Redevelopment Agency may re-take ownership of the land, if the developer fails to substantially complete the infrastructure in the time frame set forth in the city’s development and disposition agreement (the DDA)

But Lacy observes that this “nuclear option” isn’t likely to happen with so much riding on the Lennar deal, and he stresses that additional controls are needed, if the city is to ensure that the deal remains in the best interest of San Francisco, not just the developer.

Lacy’s probably right about that. (Remember how hard the community had to fight to just get an extra 15 days to read and comment on the project’s six volume draft EIR over the winter holidays?)

And how much political pressure was exerted to ram the city’s EIR for this project across the certification line on June 3, five days before Santa Clara voters decided to support a stadium for the 49ers near Great America.

“What’s needed is an impartial arbiter,” Lacy said. “The city needs regulatory controls and the capacity to fine Lennar if it breaks promises to build affordable housing, create jobs and hire locals. You’re not going to be able to hold their feet to the fire without that.”

“I’m not saying that we should be obstructionists, critics who are trying to prevent stuff for the sake of a political battle,” Lacy added. “But we need new blood. The benefit of my campaign is that I’m not downtown’s candidate. I’m a civil rights attorney, who can help the district by figuring out what battles we need to be fighting and which battles are winnable. And I want to make sure there are jobs and business opportunities for working-class folks in San Francisco. You shouldn’t have to be a doctor or lawyer to afford to live here.”

Lacy believes the Navy should remove the radiologically impacted landfill on the shipyard’s Parcel E2.
“That ground has to be taken out of there,” Lacy said. “I would hope the City Attorney’s Office would get involved and advocate for the people. But leadership is about taking a stance when no one else is.”

With the city suggesting that it can still win back the 49ers, Lacy said that he too, would love it if the 49ers decided to stay.
 
“But not at the cost of our health and safety,” Lacy said, referring to the city’s repeated claim that it needed to rush certification of the final EIR for Lennar’s project, if there was to be any hope of winning back the team.

“ I don’t think the solution is the rush,” Lacy said. “I say, let’s make sure we clean up the shipyard properly—and bring back the Warriors [a professional basketball team that relocated to San Francisco in 1962, until 1971, when it moved to Oakland].”

I also hung out with D. 10 candidate Tony Kelly, at an event that POWER hosted as part of a Progressive Planners Forum, the day after Lacy and I unsuccessfully tried to access the shipyard, and the same day that POWER was also blocked from the yard.

Kelly has been tracking issues in and around District 10 for years, and, much like Lacy,  he’s not afraid to speak his mind on the issues.

For instance, Kelly is incensed by the city’s attempt to ram through approval of the final EIR for Lennar’s development, when the Navy has yet to complete an environmental impact statement related to its proposed clean up activities at the shipyard..
“Is the EIS ever a trailer to the EIR?” Kelly asked. “It’s like planning on Mars.”

Kelly has also expressed concern over the developer’s plan to build two peaker plants in the community.

And he is worried about the consequences of the city’s plan to turn the entire Bayview into a project survey area for Lennar’s Candlestick/Shipyard plan.

“How do you pay for any other improvements in the Bayview, when the shipyard redevelopment plan sucks all the air out of the room?” Kelly said

But Kelly’s biggest concern right now is that once Lennar gets its final approvals this summer, “the developer will never talk directly to the community again.”

At the Progressive Planners Forum that Kelly attended, speakers also voiced measured criticisms of Lennar’s plan.

“The plan has some important elements, especially in the job areas, but I think it adds up to gentrification, which is disruptive to the surrounding community, families and the last bastion of the black community in San Francisco,” said Chester Hartman, who has authored over 18 books on race and urban planning, including the acclaimed City For Sale: The Transformation of San Francisco.

“There is a need for a response in terms of an alternative approach,” Hartman advised.
“It doesn’t have to be a detailed, but it should include a basic philosophy and goals, and retain good parts of the original plan.”

Peter Marcuse, Professor of Urban Planning at Colombia University, said the situation at the shipyard reminded him of the ongoing oil disaster in the Gulf.

“Cap the land sounds like cap the spill,” Marcuse said, noting that in both cases the community is fighting to get folks who dumped toxins to clean them up.

Marcuse criticized the privatization of the planning process, as illustrated by the City’s claim that it has entered into a “public-private” partnership with Lennar,  and the community’s experience that the city and the developer keep ignoring or dismissing the public’s feedback and opinions.

 “There should have been a range of alternatives open for discussion,” Marcuse said. “Instead, there is a sense, of this mega project’s inevitability. And once the developer has title to the land, the city has to negotiate what should be a public matter.”

Marcuse critiqued the use of tax increment financing, which will use increased taxes on property throughout the Bayview to finance improvements in one relatively small area, the 770 acres of land that, as Marcuse put it, “got sold to Lennar for $1.”

“This is a form of government subsidy,” Marcuse warned.

“There have been some negotiations,” Marcuse continued. He pointed to the community-led Prop. F, which in the spring of 2008 sought to establish 50 percent affordable housing in the development. And the community benefits agreement (CBA) that the San Francisco Labor Council hammered out at in May 2008, in an attempt to nail down benefits for the community in exchange for the Council’s support for the Lennar-financed Prop. G in June 2008.

“But these negotiations with Lennar start on basis that Lennar’s interests have to be protected equally with those of the City and its residents,” Marcuse commented. “It ought to be a public responsibility to show the community what the alternates to Lennar’s vision are.”

Marcuse concluded by suggesting a moratorium on Lennar’s plan to allow for a community-based visioning process, in which residents could express their desire for housing, diversity, open space and protection against environmental hazards

‘The City should then come up with an alternative to Lennar’s plan—and listen to Lennar,” he said. “But this is a public responsibility, rather than a private negotiation with a corporation that has been a beneficiary of a huge subsidy and starts to make a huge profit, the minute its housing units begin to sell.”

Miriam Chion, who works for the Association of Bay Area Governments (ABAG), also expressed concerns with Lennar’s massive plan, which proposes to build thousands of mostly luxury condos at Candlestick Point, with a smaller number on the shipyard.

“We are in the 21st century, how can we continue to use same mechanisms of displacement?” Chion said. “And how can we do that to the African American community, which we have displaced over and over, and which has managed to build a community here, in spite of everything?”

According to Lennar’s plan, 68 percent of its proposed 10,000 units will be built at market rate. Of the remaining 32 percent of units, only 15 percent will be built at truly affordable rates, with an additional 15 percent geared towards the working middle-class income levels, such as those enjoyed by police, fire fighters, nurses and teachers.

But two Bayview residents who attended POWER’s progressive planners’ forum expressed frustration at what they perceived as outsiders trying to tell locals what’s best.

“If you haven’t lived here, you don’t know about the Bayview,” one resident said. “If they are going to do what they are going to do, they should do it all the way, and change things for the better. I’m tired of seeing kids under 12, playing outside at 11 p.m. So, if you are not from here, you can’t come on my ground and pass judgment. If you’d been and lived here, I don’t think you’d see this negatively.”

“$700 million has been spent on cleaning up shipyard, and producing highly technical reports on it,”  another local resident said. “Highly intellectual discussions are not helping, we need some action today.”

“No one here is against development,” countered long-term Bayview resident Espanola Jackson, while a Bayview resident named Nyese resurrected longstanding concerns that the developer fatally broke community trust when it failed to control asbestos dust at the site, when it began grading the shipyard’s Parcel A .

“Four years ago, I found out that they were sending home workers at the shipyard, without informing the surrounding community,” Nyese recalled. “My son was having excessive nosebleeds, so it was phenomenally insulting that they didn’t not notify us.”
“Lennar is just a name, a conglomeration of shareholders,” Nyese further noted. “We need development. But we don’t need it on chemically toxic land.”

These competing concerns indicate that all the candidates in the D. 10 race are going to have to be asking critical questions as they track the progress of Lennar, the city and the Navy’s plans this summer. Failure to do so will cost them credibility within the community—and possibly the supervisor’s race this fall, though downtown money will pour in to support whichever candidate is deemed most likely to rubberstamp present and future development and contracting plans. Stay tuned. It’s going to be a (politically) hot July.

 

Lennar’s litmus test

None of the many stakeholders tracking the progress of Lennar Corp.’s massive Candlestick Point-Hunters Point Shipyard redevelopment plan registered surprise when the Board of Supervisors received three appeals to the Planning Commission’s June 3 certification of the project’s final environmental impact report (FEIR).

Instead, everybody who has been watching the political juggernaut that has been pushing for quick approval of the project over the past month said they anticipated that the FEIR would be appealed, and perhaps litigated. But the real question is whether the project will be substantially changed.

In the seven months since the project’s draft EIR was released, the Planning and Redevelopment Commissions have repeatedly rejected all arguments and recommendations made by its critics to improve or delay the plan, rushing the approval along on a tight schedule (“The Candlestick Farce,” 12/21/09).

The rush job occurred even as numerous groups and individuals warned that the DEIR comment period was too short, (“DEIR in the headlights,” 02/03/10) and complained that the city and the developer had dismissed crucial data and testimony while exploiting fears the San Francisco 49ers would leave town if the city didn’t act quickly (“Political juggernaut,” 06/02/10).

What’s less clear is whether the Board of Supervisors has the political will to heed these appeals and correct what opponents say are serious flaws in the city’s FEIR. The appeal that the Sierra Club, Golden Gate Audubon Society, California Native Plant Society, and San Francisco Tomorrow filed June 21 lists nine deficiencies.

These included the FEIR’s failure to look into an alternate Bus Rapid Transit (BRT) route around Yosemite Slough or adequately assess impacts resulting from the landfill cap on Parcel E2 and the transfer of 20 acres of public shoreline land in Candlestick Point State Recreation Area (CPSRA) to build high-end housing.

“The FEIR failed to analyze those elements of the project’s sustainability plan that could have significant environmental impacts, including two proposed heating and cooling plants (which appear to be power plants) to serve 10,500 housing units and a projectwide recycling collection system,” the coalition further charged.

The appeal also voiced concern that the FEIR failed to adequately assess impacts resulting from the construction and maintenance of the development’s underground utility matrix, impacts to the bird-nesting in the proposed 34-acre wetland restoration project at the state park, and delays to eight Muni lines.

But the Sierra Club-led coalition also indicated that by removing provisions for a bridge over Yosemite Slough, transfer of land in the state park, and compromised clean-up efforts at Parcel E2, resolution of many of these disputed issues could be expedited.

“If the Board of Supervisors acts promptly, revisions to the EIR may be made quickly and result in a minimal delay in the progress of the project,” the coalition stated.

The Sierra Club’s Arthur Feinstein told the Guardian that the coalition’s top three concerns are “very important, but the six other issues are also very real.”

“Here we have a city cutting 10 percent of its bus service while saying that eight bus routes will need to be improved because of the project, and admitting that the development will increase air pollution in a district that has the highest rates of asthma and cancer without identifying mitigations such as reducing parking spaces in the proposal,” Feinstein said.

POWER (People Organized to Win Employment Rights) also filed an FEIR appeal June 21 listing a broader range of environmental and economic justice-related concerns.

These included the FEIR’s failure to analyze and mitigate for displacement that would be triggered in the surrounding neighborhood by developing 10,500 mostly market-rate housing units in the area and “failure to provide for adequate oversight and enforcement of the terms of the early transfer” of the shipyard from the Navy.

POWER also cited the FEIR’s failure to adequately mitigate against the impact of sea level rise, the risks associated with potential liquefaction of contaminated landfill at the shipyard in the event of an earthquake, and health risks related to chemicals of concern at the shipyard. The group also faulted the city’s failure to get the Navy to prepare an environmental impact statement on its clean-up plan before the FEIR was completed.

Finally, Californians for Renewable Energy (CARE) filed a five-point appeal June 23 charging that the project contravened the intent of Proposition P (which voters approved in 2000, urging the Navy to remediate shipyard pollution to the maximum extent possible), that the project’s FEIR is incomplete because the Navy (which still retains jurisdiction over the project lands) has not yet completed its EIS, and that the FEIR approval process was tainted by 49ers-related political pressure.

“The pre-set goal of maintaining the 49ers in San Francisco has colored the environmental analysis of this decision,” CARE noted, referring to the city’s rush to get the project’s FEIR certified on June 3 — five days before Santa Clara County voters approved a new stadium for the 49ers near Great America .

The appeal filings mean the Board of Supervisors is required to hold a hearing within 30 days, a move that places a roadblock, at least temporarily, in the way of the city’s tight schedule to secure final approvals for Lennar’s megaproject before summer’s end.

Board President David Chiu told the Guardian that the Board’s Land Use Committee will move forward with a July 13 meeting to hear a list of proposed amendments related to the underlying plan along with the FEIR appeals.

“We are back at the board Land Use Committee July 12 with 10 items related to the project,” said Chiu, who is a member of the Land Use Committee. The three-member committee is chaired by Sup. Sophie Maxwell, who represents the project’s District 10; Sup. Eric Mar is vice-chair.

“The next day, July 13, has been tentatively set for a full meeting of the full board,” Chiu continued. He acknowledged that the FEIR related materials are dense and complex, telling us that “they form the largest pile on my desk, and it’s about five inches high.”

But he wasn’t about to prejudge the outcome. “We do need to clean up the area and rebuild it in such a way that it will dramatically increase affordable housing and jobs and support a livable diverse community,” Chiu said. “Obviously there are still a lot of questions and concerns about the proposed project and the board will push to make sure all these issues are adequately addressed.”

CARE president Michael Boyd said he hoped the board would take his group’s appeal seriously and fix the plan’s fundamental shortcomings. “That means going back to square one,” he said.

But others were less sure that the board would seek to overturn the entire plan. “Everyone in the community would like the best level of clean-up,” said Saul Bloom, whose nonprofit Arc Ecology has tracked the proposed shipyard clean-up for three decades. “But what’s possible and practical? And will the city be supportive of that or the most expeditious solution?”

Bloom reserved gravest concern for plans to cap, not remove, the contaminants from the shipyard’s Parcel E2. “The concern is that if you put a cap on E2 without a liner then contaminants could scootch out during a seismic event, or over time, and cause problems because of the parcel’s close proximity to surrounding groundwater and the San Francisco Bay,” he said. “But to place a liner in there is very expensive because you’d have to excavate E2, at which point you might as well replace it with clean soil.”

Bloom acknowledged that the Navy has argued that excavation would cause a nasty smell and nobody knows what is going to be released in the process.

“But long-term Bayview residents like Espanola Jackson have made the point that the community already lives within nose-shot of the southeast sewage treatment plant and would rather put up with a few years of nasty smells, given the relative benefits of cleaning the yard up,” he said. “And how do we know a cap will be protective given the Navy’s argument that we don’t know what’s down there?

“The thing that makes the most sense here is to clean up the shipyard to the best possible extent, but the city isn’t planning to do that,” Bloom added. “And the environmental community’s bottom line has always been the bridge [over Yosemite Slough, which the Sierra Club opposes]. So the sense is that if the bridge goes away, so does their problem.”

Goodbye, 49ers — and do we really care?

Tony Winnicker, the mayor’s press secretary, was chatting with a group of folks at the Newsom victory party on election night, and Steven T. Jones, the Guardian city editor, asked how the stadium vote was going down in Santa Clara. “Oh, it’s winning, but it’s never going to get built,” Winnicker said. “Cities building stadiums is an economic loser.”


He’s right, of course — although it’s an odd comment coming from a press staffer for a mayor who is still dead set on building a stadium for the 49ers at Candlestick Point. I agree with Randy Shaw: The loss of the 49ers would be a good thing for San Francisco — particularly if the alternative is to pour public money into another expensive boondoggle like Candlestick Park.


Here’s the thing: You can argue that urban baseball stadiums bring economic benefits to the community. You can argue that the (mostly) privately financed Giants stadium has spruced up that neighborhood, spurred the creation of new bars and restaurants, brought in new tax dollars and created jobs. (It also displaced some blue-collar jobs and some poor people, but that’s a different argument.)


In fact, with limited parking and good transit access, the Giants ballpark encourages foot traffic, which encourages people to patronize local businesses before and after the game.


Football stadiums are traditionally very different. Football fans are tailgaters — they drive cars, bring their food and drinks to the parking lot, set up grills and picnic tables, go to the game — and then go right home. Almost nobody who attends a 49ers game at Candlestick stays around in the neighborhood afterward; the people who live nearby get virtually zero economic benefits.


Even as part of a shiny new development package, that won’t change much. The plans for a 49ers stadium in the new redevelopment area include a new roadway and bridge to make it easier to drive in and out, and a parking garage with room for tailgating; the fan base is largely from the Peninsula anyway. And in nearly every city that’s put up public money for a football stadium, the taxpayers have gotten screwed.


I love football, I love the 49ers, but I never go to the games, anyway — way too expensive. The TV feed from Santa Clara will be just fine.


 

Day after 49ers vote, EPA says shipyard dust monitoring OK

The day after the 49ers scored “a touchdown with Santa Clara voters“, the U.S. EPA announced it has finalized a report about asbestos dust control issues at the Hunters Point Shipyard.

Maybe the timing is all just a big coincindence. But the U.S. EPA was hopping mad earlier this year when Lennar claimed that “Obama’s EPA” had declared the shipyard dust conditions safe, after viewing a draft copy of the U.S. EPA report.

So, there’s one worldview that says the U.S. EPA delayed release of its final report, so it wouldn’t get mixed up in the city’s hearings on the final EIR for Lennar’s Candlestick/Shipyard development.

Either way, if the 49ers really do leave, that’s more land for Lennar to build houses on.

There’s also the worldview that says the 49ers used the Santa Clara vote to squeeze a better deal out of San Francisco.(And as Lenny Kravitz likes to sing, it ain’t over ’til it’s over.)

But with city officials admitting  that it doesn’t make financial sense to build a new stadium, it’s easy to arrive at the view  that the city used fears that the 49ers would leave to rush approval of the city’s final EIR for the Lennar project, a vast document that could have used more scrutiny and review time.

Anyways, amid  the competing conspiracy theories, it’s worth taking the time to read the report i its entirity. And if you don’t have the time for all that, here is the full text of the cover letter that the US EPA released today:

“Dear Bayview Hunters Point Community and Stakeholders:

EPA has finalized the report entitled, “U.S. EPA’s Final Review of Dust/Naturally Occurring Asbestos Control Measures and Air Monitoring at the Former Hunters Point Naval Shipyard (June 9, 2010).” 

“About the Report:

EPA conducted a technical review of dust mitigation plans and an independent laboratory analyses of data associated with the City and Air District’s efforts to control naturally-occurring asbestos and dust associated with construction activity on Parcel A at the former Hunters Point Naval Shipyard. EPA also evaluated metals and radiation data for both the Parcel A development work and Navy activities on the Shipyard. “

“EPA made independent technical advisory services available to community members to review the data and EPA’s draft report.  EPA held a public meeting for the community to hear comments from the technical expert.  The comments and EPA’s responses are attached to the final report. “

“Naturally-occurring asbestos in dust at construction sites is a widespread concern in California where serpentine soil is common.  EPA’s report finds that best practices for dust monitoring and mitigation are in place at Parcel A and the Hunters Point Shipyard to protect the community by keeping exposures to asbestos, metals and radiation in dust within
acceptable levels.”

Harris declares victory in AG Democratic primary

San Francisco District Attorney Kamala Harris declared victory in the Attorney General Democratic primary in an energized  speech around 11 p.m. at Mimi Silbert’s Delancey Street Foundation at 600 Embarcadero.

Harris’ speech came soon after the room buzzed with the news that Santa Clara voters had approved a $937 million stadium deal for the 49ers at a site near Great America, and immediately on the heels a rousing introduction by State Sen. Mark Leno.

“With her kind of leadership, we’ll be able to reinvest dollars in the best crime prevention programs,” Leno said.

Harris’s campaign raised $3 million in the Democratic primary, and Leno indicated that supporters would need to “triple or quadruple that in the general election.”

Leno promoted medical parole and praised Harris’ Back on Track program for reducing recidivism rates for young, first time offenders.

“With your help we will elect the first woman to be Attorney General for the state of California,” Leno promised.

 Then Harris took the podium, dazzling in a chic black outfit and pearls.

Acknowledging the work and efforts of her supporters, Harris broke into a big smile.

“I do humbly accept the Democratic nomination for Attorney General of California,” she  said.

She praised good ideas that her fellow Democrats raised during the primary around fighting gang crime, corporate greed and fraud, protecting kids and the environment.

‘It’s been an honor to work with you,” Harris said, promising to call her opponents, “to ask you to help us put those great ideas to work.”

Then she talked about getting “tough and smart on crime” by addressing gang crime, but also focusing on early intervention and truancy.

She talked about cracking down on predatory lenders, supporting health care reform, and protecting California’s environment.

“When the President passed healthcare reform, it was the right thing to do,” Harris said. “People deserve to have medical care when they need it. The Attorney General has got to stand up and support that. It must be the work of the next Attorney General to ensure that the disaster and tragedy that happened in the Gulf of Mexico never happens in California,” she said, warning of attacks on AB 32, which set California’s 2020 greenhouse gas emissions reduction goal into law in 2006. “

And she described her campaign touching down in Modesto, Bakersfield, Oakland and Palo Alto and stretching from “grassroots to net roots,” ,

“We may seemingly be different because of our zip codes, perhaps, but we are all the same in terms of what we want for children.. elders,” Harris said, promising, “to protect poor people, the vulnerable and people who are the targets of bias.”

“We have a lot of work to do before November…but we are clear of purpose, clear of mind,” Harris said. “We believe in hard work, but we also believe that if can be fun work. Let’s celebrate tonight!”

And then she was off the stage, shaking hands with fans .Asked about the possibility of becoming the first female California Attorney General, Harris flashed that dazzling smile.“I’m sure a man could do the job just as well,” she said. “Let’s leave it at that for now.”

 

 

Newsom and his commissioners just love Candlestick/Shipyard report

Today, I’m dedicating Michael Franti’s  “Say hey, (I love you)” to the entire Redevelopment Commission and the four Planning Commissioners who approved the City’s final Environmental Impact Report plan for Lennar’s Candlestick/ shipyard development. I’m doing so, not because I love these commissioners, who are  all mayoral appointees, but because they all seem to love everything about the final report, despite ongoing concerns about building a bridge over an environmentally sensitive slough, taking park land for luxury condos and unresolved questions about the Navy’s cleanup of the shipyard.(Yes, the EIR doesn’t address the toxic cleanup, but does it make sense to approve it before the Navy has completed its cleanup assessment plan?)

I’m also dedicating Franti’s bubbly soul-lifting song to Planning Commissioners Christina Olague. Kathrin Moore and Hisashi Sugaya for refusing to rubberstamp the final EIR or the related CEQA findings. Thanks guys for having some moral backbone!

Mayor Gavin Newsom, presumably tweeting while leaving town again on the Lt. Governor campaign trail, hailed yesterday’s rubberstamping process as a critical milestone.
“This is a major milestone for our efforts to transform the shipyard from an environmental blight to a showcase of jobs, affordable housing, parks and green-technology investment for the Bayview and our entire City,” Newsom said in a press release. “The approvals of the EIR and Redevelopment Plan reflect the years of hard work, rigorous study and extensive community involvement invested in revitalizing our City’s Southeastern Waterfront…our progress today is a testament to their leadership and commitment to thoroughly cleaning up the Shipyard so we can forge ahead towards a new vision for Hunters Point.”

One of the key points to emerge from last night’s hearing is the bifurcated nature of the process, which yesterday let the city push the EIR certification through, before the Navy completes a related EIS (environmental impact statement) about the cleanup on the shipyard—including areas of land where Lennar hopes to develop homes if the 49ers leave.

Fog City Journal’s Luke Thomas told me today that during public comment, the Nation of Islam’s Minister Christopher Muhammad called the commissioners “paid prostitutes” and “political whores” and said there would be a “political earthquake” if the commissioners go forward with EIR. 

“However, I don’t think he understood that the EIR and the EIS (which deals with the toxic cleanup) are two separate documents,” Thomas said, accurately noting that the joint commission was only voting on the EIR yesterday.

(According to Thomas, the Minister also promised that coalition of activists that would dog Newsom up and down the State during his campaign for Lt. Governor to expose Newsom’s record, so expect more fireworks along the campaign trial this summer.)

Another key fact to emerge from yesterday’s hearing was the lack of public comment on the part of almost all the candidates running to replace D. 10 Sup. Sophie Maxwell, whose district includes this massive development. Only Kristine Enea, Tony Kelly and Espanola Jackson spoke on the record—with Enea in favor of the plan with amendments, and Kelly and Jackson opposed as things currently stand.

Now, you’d think that everyone running in this race would be eager to show D. 10 constituents (and beyond) that they were at the meeting, not only silently tracking, but also publicly expressing their opinions. And while it’s true that Marlene Tran and DeWitt Lacy filled in speaker cards, Chris Jackson showed up during the proceedings, and Lynette Sweet got ushered into the press box by Sup. Bevan Dufty, none of these D. 10 candidates got their thoughts in the public record. Now, no doubt Cedric Akbar, Bill Barnes, Isaac Bowers, James Calloway, Malia Cohen, Ed Donaldson, Marie Franklin, Rodney Hampton Jr., La Vaughan Moore, Geoffrea Morris, Steve Moss, Jacqueline Norman, Nina Pickerrell, Dwayne Robinson, Diane Wesley Smith, Eric Smith, (and the many others rumored to be running) had their reasons for not being there, and I’d be happy to hear all about it from all of them between now and the November election.

But it doesn’t instill confidence in candidates when they won’t say in public what they are only too willing to say off the record. So, kudos to Enea, Kelly and Jackson for taking that leap and refusing to act like politicians before they have even been elected.

“So much of it was shocking but not surprising,” Tony Kelly told me today, after he recovered from last night’s meeting which lasted until 2 a.m. ‘Everyone knew there would be a snappy 4-3 decision by the Planning Commission on the stuff that mattered. And in a way, I can see why the mayoral appointees on the Commission would decide that they would leave it to the elected officials on the Board to stop this plan. But there was zero excuse for the lameness of the Redevelopment Commission [who are all mayoral appointees]. Still, it showed what the Planning Commission [which today consists of four mayoral appointees, and three Board appointees] must have been like  before it was reformed [and still consisted solely of mayoral appointees].”

“It was heartbreaking to see the endless parade of Bayview Hunters Point residents saying, ‘I need a job,’ or ‘ I need to live in a new house,’ as they argued in favor of certifying the project’s final EIR, despite all the flaws,” Kelly acknowledged.

Still, as Kelly points out, the city could have pushed to acquire foreclosed housing in D. 10 so residents in substandard public housing could be relocated into decent units now, instead of having to stay at least another five years, or longer, in rat, cockroach and sewage inundated units, under Lennar’s plan.

Kelly also notes that the city could have used the Redevelopment Agency’s “massive power” to do stuff up and down Third St, where unemployment is especially visible.

“Having done planning elsewhere, this plan [for Candlestick and the shipyard] is like planning on Mars,” Kelly said. ‘This is a bigger badder version of 555 Washington.”

Last but not least, Kelly voiced concern that a couple of peaker plants will be built within Lennar’s project area.
.“There are going to be two combustion turbines generating steam heat, but not electricity within the project boundaries,” Kelly clarified. “That means they don’t have to register as a power plant, but they will be generating greenhouse gases. The only difference is they won’t be generating electricity.”

So, now the charade of approvals heads to the Port Commission, which has got some folks asking whether Port Commissioner Stephanie Shakofsky, another Newsom appointee should recuse herself , given that her non-profit is clearly such a fan of the project.

 

 

Should Antonini recuse himself from Lennar vote?

As a Newsom appointee, Planning Commissioner Michael Antonini is expected to be a key vote today in favor of Lennar’s massive redevelopment plan at Candlestick Point-Hunters Point Shipyard.

And then there’s the fact that he wrote an op-ed for the San Francisco Business Times in December 18, 2009, suggesting that business, civic, labor and government leaders can keep the 49ers in town by “joining forces to assist in needed repairs and improvements to Candlestick Park and to expedite development of the Candlestick Point Hunters Point Shipyard, a project that features a “state-of-the art,” 69,000-seat football stadium.”

But Antonini’s cheerleading has got some folks questioning his impartiality when it comes to the decisions that members of the Planning and Redevelopment Commissions will make today around certifying the project’s Final Environmental Impact Report (FEIR) and adopting related environmental findings.

In a June 2 letter to Planning Commission president Ron Miguel, Arthur Feinstein of the Sierra Club, Mike Lynes of the Golden Gate Audubon Society, Jennifer Clary of San Francisco Tomorrow and Jaron Browne of POWER (People Organized to Win Employment Rights) claim that “Commissioner Antonini has clearly prejudged the proposed project and become a strong advocate for locating a football stadium for the 49ers at the Hunters Point site as part of this project.”

“He has publicly urged others to support that stadium and cannot impartially review the record before him to determine whether the EIR is adequate, accurate and objective and whether adequate measures are required to protect the environment,” the foursome continue.

 Noting that he could have chosen to sign the December 2009 op-ed as a Member of the Republican County Central Committee, Feinstein, Lynes, Clary and Browne observe that Antonini “ instead identified himself in the capacity where the law requires him to act impartially – as a Planning Commissioner.”

With others arguing that Antonini’s right to express his opinion is protected by the First Amendment, and Antonini planning to read a rebuttal into the record at 1 p.m. today, it sounds like there’ll be plenty of drama at today’s hearing.

Business leaders can save the Niners

“The 49ers are deeply and historically identified with San Francisco. San Franciscans Vic and Tony Morabito founded the team in 1946, many years before the Giants moved from New York and the Warriors from Philadelphia.

Hence business, civic, labor and government leaders are joining forces to assist in needed repairs and improvements to Candlestick Park and to expedite development of the Candlestick Point Hunters Point Shipyard, a project that features a “state-of-the art,” 69,000-seat football stadium. Leaders from the Committee on Jobs, the San Francisco Chamber of Commerce, Recreation and Park and others are asking businesses and individuals to help with funding of improvements at Candlestick in return for advertising. These improvements could translate into increased revenue for the contributor, the city and the team. Replacement of aging seats and a highly visible new luxury section are two concepts being studied.

Naming rights to Candlestick Park is an attractive opportunity for a company or an entity to gain nationwide exposure and local acclaim — and, perhaps, position itself to be a key contributor when a new stadium is built at Hunters Point. No new stadium can be built anywhere without significant private investment, in addition to $100 million assured from Lennar Corp. as a precondition of development rights and the amount which the 49ers ownership would invest.

On Thursday, Dec. 17, the San Francisco Planning Commission was to hear comment on the Draft Environmental Impact Report for the Candlestick Point Hunters Point Shipyard Plan. Because this plan features many diverse uses, particularly huge amounts of housing, funding is being rapidly obtained for greatly improved transit and traffic access.

San Francisco must avoid the errors of the past, when we failed to build an arena for indoor sporting, major conventions and entertainment events. Such a facility could have brought huge amounts of revenue to San Francisco businesses.

Leaders have twice stepped up to save the San Francisco Giants. One would expect no less from our leaders when dealing with our home grown, five- time Super Bowl champion San Francisco 49ers!

Political juggernaut

City officials are scrambling to secure final approvals to allow Lennar Corp. to move forward with its 770-acre Candlestick/Hunters Point Shipyard redevelopment of San Francisco’s impoverished and polluted southeast sector. But the community remains divided on the project, raising concerns that wary residents will end up being steamrolled by this politically powerful juggernaut.

Some groups say the project needs major amendments, but fear it will be rushed to the finish for political reasons. Others say they are hungry to work and desperate to move into better housing units, so they don’t want all the myriad project details to slow that progress. And Mayor Gavin Newsom’s administration is arguing that approving the project’s final environmental impact report by June 3 is crucial if San Francisco wants to keep the San Francisco 49ers in town.

But many observers fear Lennar wants its entitlements now before its project can be subjected to greater scrutiny that could come with the November elections. Newsom, who made Lennar’s project the centerpiece of his housing policy, will be replaced as mayor if he wins the lieutenant governor’s race. And a crowded field of candidates, many of them progressives concerned about the project’s impacts on the poor and the environment, are vying to replace termed-out Sup. Sophie Maxwell, whose district includes Lennar’s massive territory.

“It’s 180 percent about the 49ers,” land use attorney Sue Hestor told the Guardian, referring to the city’s proposed rush job, as evidenced by a rapid entitlement schedule that the Newsom’s administration wants city commissions and the board to follow.

Under that schedule, which Hestor procured from the Mayor’s Office, Planning and Redevelopment commissioners are expected to certify the project’s final 6,000-page EIR, adopt California Environmental Quality Act findings, approve amendments to the project’s original disposition and development agreement, and authorize land trust and open space reconfigurations — all during a June 3 meeting where public comment will likely last for many hours.

Saul Bloom, executive director of Arc Ecology, a community-based nonprofit that tracks the development, says this schedule stretches the credulity that this is a deliberative process. “There’s no way anyone could make a functional reasoned assessment,” Bloom told us. “How do you have any meaningful public conversation under those circumstances?”

Michael Cohen, Newsom’s chief economic advisor, asserted in an April 29 article in The New York Times that Lennar’s plan is a “really, really good project,” echoing the glowing praise he’s heaped on the project since its conception.

“But there’s nothing new in their proposal,” Bloom told us. “That’s because they haven’t been listening to the public’s concerns. [Cohen] says, ‘Haven’t we talked enough? The community’s been waiting all these years!’ But waiting to get what done?”

Lennar’s project — which had early backing from Newsom, U.S. Sen. Dianne Feinstein, and other political power brokers — was sold as creating “jobs, housing, and parks” and “revitalizing the abandoned shipyard” when voters approved the Lennar-financed Proposition G in 2008.

“Proposition G is from the community and for the community,” Lennar’s campaign promised. “You can turn the abandoned Hunters Point Shipyard into a clean, healthy, sustainable, livable neighborhood — a place where people can raise their children.”

The shipyard once employed thousands of workers, including African Americans who were recruited from the South in the 1940s and ’50s. But the district’s economic engine fell into disrepair when the military left in 1974. Today the neighboring Hunters Point and Bayview neighborhoods have the highest unemployment and crime rates and the largest concentration of African American families in the city.

But the city’s final EIR for the project, which the Planning Department released mid-May, shows that 68 percent of the developer’s proposed 10,500 new housing units will be sold at market rates unaffordable to area residents, and that many of these units will be built on state park land at Candlestick Point.

Lennar is also proposing to build a bridge across the environmentally sensitive Yosemite Slough, significantly changing the southeast waterfront. Lennar says it plans to develop the project’s remaining 3,000 units at below market prices, including one-for-one replacement of rundown Alice Griffith public housing units. Its proposal includes a dozen high-rise towers, 2.7 million square feet of commercial space, 1 million square feet of retail space, a performing arts theater, and an artists colony.

Lennar claims its proposal will create 1,500 construction jobs annually during the project’s 20-year build-out, along with 10,000 permanent jobs, thanks to a United Nations Global Compact Sustainability Center and a vaguely defined green technology office park.

The project and its impacts are already an issue in this year’s District 10 supervisor’s race (see “The battle for the forgotten district,” Feb. 23). Candidate Chris Jackson says Lennar’s proposal is weak when it comes to creating well-paying, low-skilled green collar jobs. He supports Arc’s proposal to including green maritime industrial use at the shipyard.

Arc recommends that the city’s final EIR allow recycling and repairing of ships, including the Suisun Bay Ghost fleet — decommissioned U.S. Navy, cruise, and ferry ships — arguing that “ship recycling and repair are resurgent strategic industrial activities yielding employment opportunities for our existing pool of skilled and unskilled workers.”

Jackson, who was elected to the Community College Board in 2008 and recently jumped into the District 10 race, wants the city to assert that the project is not a regional housing plan.

“It’s a local housing plan for local residents,” Jackson asserts. “It’s not here to provide housing for Silicon Valley. It’s for Bayview-Hunters Point and District 10 residents.”

Jackson understands why some local residents want no delays on final EIR approval: “I can never blame folks in Alice Griffith public housing for coming out and saying ‘no delays.’ They really want something real, housing that is not rat and cockroach infested.”

As a policy analyst (a position he’s quitting to focus on the District 10 race) for the San Francisco Labor Council — which gave key backing to the project in the 2008 election — Jackson knows labor is frustrated by all the project meetings. “I try to tell them it’s better to get this project right than rush it through and find out later that it goes against the interests of labor,” Jackson said.

In May 2008, the Labor Council signed a community benefits agreement (CBA) with Lennar. Since then labor leaders have urged no delays on the project’s draft EIR review. But Jackson believes the city must demand that financial consequences, such as liquidated damages, be a project approval condition if the developer reneges on the CBA.

“Right now the only push-back the city has is to threaten to kill the whole project if Lennar doesn’t meet its timeline,” Jackson said. “But people are really invested in this project, and I don’t believe anyone would pull the trigger and end the entire development. We don’t need to throw everything out; we just need to change them.”

Jackson wants to see the inclusion of a special-use district that would create a cooperative land trust to ensure affordability and home ownership opportunities for local residents. “I love open space and sustainability, but I also want affordable housing and real light-industrial opportunities that can employ people living in the district now.”

Special-use districts, Jackson argues, give city commissioners a way to amend this project to make it more acceptable.

Jackson wants to see strong tenant protections for public housing residents. “The vast majority of those residents are African American. At the end of the day, I want to see economic and environmental justice, so we can say we brought the right change to our community.”

Jackson also would like to see a more independent Mayor’s Office. “Don’t you feel like its 2002/2003, and that if you speak out against the project, it’s like you are speaking out against the Iraq war, and all of a sudden you are not patriotic?”

Fellow District 10 candidate Eric Smith concurred. “The powers that be are definitely moving this thing forward,” he said. “And this is a monster train, a juggernaut that is gathering steam. But how it shakes out down the road remains to be seen. My whole mantra is that there needs to be greater transparency down the line. If I become the sheriff, I’ll be shining a light on all this stuff.”

Smith warned that the community needs to work together or it won’t win a better deal. “It’s clear that folks in the city are hoping against all odds that Lennar can pull this stuff off so they can prove all the naysayers wrong and these community benefits can be realized, and that scrutiny of the projects can go on while all this happens,” he said.

But Arthur Feinstein, the Sierra Club’s political chair, worries that the city’s rush job is resulting in seriously flawed documents and decision-making. “It’s difficult for folks to digest 6,000 pages of comments and responses on the draft EIR in the three weeks since planning posted them online,” Feinstein said. “And nothing has changed despite all the comments, which is why it continues to be a nonsense process.”

Feinstein says the Sierra Club’s top concerns are the Parcel E-2 cleanup on the shipyard, a deal to transfer 23 acres at Candlestick Park for development, and the bridge over Yosemite Slough.

“You can cover most of the site,” he said. “But when it comes to Parcel E-2, where the dump burned for six months in 2002, that’s only 20 acres, it could and should be removed. This is the environmental justice issue that has the community up in arms.”

Feinstein worries about the precedent that selling a state park for condos sets. “This is our park, and they are shrinking it.” He is also concerned that the developer wants to bridge Yosemite Slough for cars.

How many of these concerns will be addressed at the June 3 hearing, which is just days before Santa Clara County voters decide whether to try to lure away the 49ers with a new publicly financed stadium? We’ll see.

CHEAP EATS Dear Earl Butter,

Thank you for putting real flowers and tiny plastic battery-operated candles in your closet for me. I slept like an angel that snores like a truck driver. Speaking of which, thank you for the chili and cornbread too. It made my homecoming that much sweeter and spicier, in addition to giving me gas. Which I am happy to have, and allowed to have, praise God, now that I’m back in a Free Country.

Plus the Maze of course, being beautiful, was waiting for me at the airport with a huge colorfully hand-painted sign that read, “Welcome home, Dani. We love you.” Signed: “The Bay Area.”

He admits having had help with the wording from at least one person, and with the painting from a couple more, so maybe there is some truth to this. If so, the feeling is very very mutual.

I will never leave the Bay Area ever again, not even to go camping. Just think, while my ex and my ex’s ex-ex are holed up together in their dark, cold, provincial town in southern Germany, clinging to each other’s small corner of obscurity, writing and editing their mediocre novel that is set in San Francisco, I get to live here. And love and be loved, and play and work and eat here.

I can’t speak for working, exactly, but it’s the greatest playing and eating place in the world that I know of. Here.

There, do you know what they eat, Earl? Well, the ex’s ex-ex doesn’t cook, and my ex’s specialty is ramen noodles. That’s what they call cooking. When they go out, it’s for sushi. Really really bad landlocked German sushi. Imagine!

Meanwhile, I have been shucking fresh-picked oysters and scallops on the west coast of France, inventing home-raised cherry chicken-heart stew, eating up Paris and Rome, hobnobbing with extraterrestrials, crunching into crack conch in the Caribbean, and passing the guitar with a couple Haitian boys outside their single-family chicken-coop shack.

And now … now I get to go get a burrito. Whenever. The fuck. I want. Because that’s what San Francisco is. It’s “what kind of beans,” the best of all-things-edible, and raw onions and garlic no matter who you might breathe on afterward. No problem. We live here.

Anyway, I do. You do. And I do again. I can’t think of a more appropriate way to celebrate my 20-year anniversary of moving to San Francisco than moving back to San Francisco.

St. Patrick’s Day 1990 was the day. I still remember my amazement, the air and the sky. Thank you for getting me back in, Earl — albeit on the ground floor, literally, with an option on your upstairs apartment’s closet. But I breathe better in closets than I did in small-town Germany, and I see more sky in one heartbeat here, through my dirty, barred sidewalk window, than I saw all this winter there. The Winter of My Discombobulation.

And now, if you will excuse me, m’dear, I have to go recombobulate.

That is great. We went to Urbun Burger because the Mission has a lot of places to eat. You wanted to walk around because you have returned. I know the area and fear I will never be able to leave, except, perhaps for my parents’ funerals. We went to the Community Thrift where 15 or so years ago, you found that really neat 49ers glass, and that made me jealous because I never, ever found a glass I really liked. Years later, when I read in your column that it had broken, I was happy. Karma, sigh, is on me.

But Urbun Burger. Lotta money, lotta meat. These burgers are 1/2 pounders. It was not $10 for my California Sensation burger, it was $9.50, and naturally I did not pay. There are a couple of burgers over $10, but they come with good fries. Super selection of condiments and a real nice, lively atmosphere. I enjoyed the colors in there. So did you.

And so it ends, my fit of usefulness to the good people of San Francisco. Yours begins anew. Welcome back. I hear it is a very good town.

SF officials tap corporate cash

San Francisco’s $500 campaign contribution limit makes it tough for rich individuals and corporations to curry favor with local politicians, right? Well, not really. Actually, politicians can still tap wealthy interests for tens of thousands of dollars for their special events and pet projects, as long as they fill out a form called “Payments Made at the Behest of an Elected Officer” within 30 days.

Traditionally, those forms have been buried in the files of the Ethics Commission, but the agency recently put them online, a rare bit of user-friendly sunshine from this often-toothless watchdog body. A Guardian review of the forms shows it is almost exclusively the city’s most fiscally conservative elected officials who use this tactic, tapping a relatively small pool of downtown power brokers.

When Sup. Michela Alioto-Pier wanted to support a Bizworld Foundation event in December, she had Pacific Gas & Electric donate $5,000 on her behalf. Sup. Sean Elsbernd throws a big annual crab-feed fundraiser in February, with proceeds going to the Laguna Honda Foundation. The form for this year’s event isn’t in yet, but last year he got $5,000 each from all the top anti-progressive funders: Don Fisher, Dede Wilsey, Charles Schwab, Warren Hellman, Platinum Advisors, and the San Francisco Association of Realtors.

But far and away the biggest beneficiary of these kinds of corporate donations is Mayor Gavin Newsom, who submitted more than half the forms on file. For last year’s Sunday Streets events, he tapped the Hellman family for $30,000, Blue Shield for $10,000, his favorite developer Lennar for $10,000, and Lennar subcontractor CH2M Hill for $5,000. The year before, the top Sunday Streets donors (at $20,000 each) were California Pacific Medical Center (which is seeking city approval to build two new hospitals) and Catholic Healthcare West.

For his swearing-in events in 2008, Newsom tapped old family friends Gordon and Ann Getty for $30,000, the Fisher family for $20,000, and Charles Schwab, Dede Wilsey, and Marc Benioff for $15,000 each. And, of course, PG&E gave him $10,000.

When Treasurer Jose Cisneros was starting his Bank on San Francisco program in 2008, he had Wells Fargo donate $20,000. When Sup. Bevan Dufty wanted to create Mission High School scholarships in his name, he called his friends Denise and John York, owners of the 49ers, to cut a check for $19,000.

Only one official from the progressive side of the local political spectrum turned to these big donations for help, and that was then-Sup. Aaron Peskin in 2007, when he wanted to raise $84,000 to buy a Telegraph Hill property to turn into open space. His top donors were the Gerson Bakar Foundation for $34,000 and 1301 Sansome LLC for $15,000.

So if you want to find out how downtown corporations are supporting the politicians they favor, keep your eye on this valuable new online resource.

The battle for the forgotten district

This November, when voters in District 10 — the largest, sunniest, and most diverse of the city’s 11 supervisorial districts — replace termed out Sup. Sophie Maxwell, they’ll be making a selection that could have pivotal implications for the entire city.

That’s because the next supervisor from southeast San Francisco inherits a district that is home to some of the city’s biggest environmental and public health challenges, as well as the most potential for development that will determine what kind of city San Francisco becomes.

District 10 is where you’ll find the most polluted and most underdeveloped lands in San Francisco, areas that could either be transformed into models of a sustainability or, in the words of Tony Kelly, the president of Potrero Boosters Neighborhood Association, “be turned into a toxic Foster City.”

District 10 is where the slaughterhouses, tanneries, and glue factories set up shop and used the bay as a dumping ground. It’s where the smokestacks of coal and oil fired power plants polluted the air. It’s where the Navy filled the Bay, built a shipyard at Hunters Point and loaded parts of the first atomic bomb onto the USS Indianapolis in 1945.

District 10 is where the bottom fell out of this industrial economy in 1974, when the Navy left, taking with it people’s jobs, pay, and hopes for a home of their own and a better future, particularly for what was then a predominantly African American population.

And District 10 is ground zero for plans that will triple the population and double the number of homes — homes that likely will only be “affordable” to Google executives and retirees from Marin, forever changing the face of San Francisco’s southeast sector. Critics fear that will accelerate what has been a steady exodus of black residents, replaced by megadeveloper Lennar’s vision for a new D10.

It’s against this dark history and difficult present that a wide open field of more than a dozen candidates are vying to replace Maxwell, who came to power in 2000 and has had a mixed voting record in her decade on the board. Sometimes, Maxwell was the eighth vote that let the progressive majority on the Board override Mayor Gavin Newsom’s veto and pass trailblazing legislation. Other times, she was the swing vote that allowed the moderate minority to carry Newsom’s water.

So, in addition to D10’s many internal challenges, this seat could determine the political balance of power on the Board of Supervisors, placing all the more importance on voters in this long-marginalized part of town.

 

DISTRICT OF DISCONTENT

Eric Smith, a biodiesel activist who has thrown his hat in the D10 ring, says that there is a lot of frustration in the air, and looking at the problems the district is facing, it’s hardly surprising that it has what nearly every candidate agrees is a fractured political culture.

“The Bayview, the Hunters Point Shipyard’s toxic Superfund site, the homicide rate, unemployment, poor public transportation, dwindling services and community resources have made D10 one of the city’s largest melting pots of discontent,” Smith said.

Smith’s words were spoken while the Elections Department was verifying signatures earlier this month on a second failed effort to qualify a petition to recall Maxwell.

Bayview resident and D10 candidate Marie Franklin didn’t support the attempt to recall Maxwell, but she understood it as “a frustration movement.”

“People are sinking in the sand, we’ve already lost so many of them, and they felt Sophie wasn’t doing anything for them,” said Franklin, who praised Maxwell for helping get Franklin’s apartment building complex renovated — a job that was completed 18 months ago, at a cost of $65 million, creating 500 local jobs.

“There are 654 units here, and they were uninhabitable,” Franklin said. “There was black mold, rain falling inside. We had people living worse than Haiti.”

Franklin, who said she is running because she “knows the history,” came here in 1978, when she and her son were living in a car after a fire left them homeless. She said the Bayview was a totally isolated area, barely part of mainstream San Francisco.

“There were no taxis, no services,” she recalled. “Nobody would come here, it was the stigmatized area where no one was accountable to provide services.”

The Bayview — which in some ways is the heart of D-!0 — wasn’t always a black community. But African Americans have been living here for 70 years, dealing with all the racism, denial of services, poverty, and pollution. And it bothers Franklin that 85 percent of the 10,500 homes that Lennar plans to develop won’t be affordable to the elderly, disabled, unemployed and low-income people who currently live in the Bayview.

“We need to preserve the diversity of the community and make sure their issues and information will flow to City Hall,” she said. “You must give the people a handle. If you don’t reach out, they’ll slip. That’s why folks out migrated.

Whoever succeeds Maxwell will be a central player in addressing some very big and dirty issues: the future of the Navy’s radiologically impacted shipyard at Hunters Point, Lennar’s massive redevelopment plan for the Shipyard and Candlestick Point, the polluting power plants, replacement of stinky digesters at the sewage plant, and the SF Hope public lousing rebuild.

There’s also the chance to address violence and crime. James Calloway, a candidate who has long worked in Bay Area schools, told us he believes that education and jobs are part of the keys to rejuvenating the district.

“Job opportunities are not as plentiful in the district,” Calloway said. “When I was a kid, you could walk down Third Street at 2 a.m. Now I wouldn’t walk down it at 9 p.m., and I know the area.”

Calloway is hopeful that the massive redevelopment plan, if done correctly, could start the district’s comeback. “Not a lot of black folks stay here when they have extensive education,” he said. “But it’s not only them. Many were displaced by redevelopment and had no way to go back.”

 

ELECTION UP FOR GRABS

The largest of the city’s 11 electoral districts, D10 is a huge triangular piece of land in the city’s southeast sector that was used as an industrial dumping zone for decades. Today, the district runs from the Giants stadium at AT&T Park to the 49ers stadium at Candlestick Point and encompasses Mission Bay, Potrero Hill, Dogpatch, India Basin, Portola, Little Hollywood, and Visitacion Valley. It’s also crossed by two freeways that isolate it from the rest of the city, and is home to a large number of crumbling housing projects that are in the process of being rebuilt.

Candidate Ed Donaldson grew up in the projects until he was 10 years old, when the Redevelopment Agency kicked his family out in the 1970s. “We landed on our feet, but others weren’t so lucky,” said Donaldson, who works as a housing counseling director at the San Francisco Housing Development Corporation.

“There is a sense that the Bayview and Visitacion Valley have not been included within the San Francisco family,” Donaldson said. “There is a sense of being forgotten.”

In 2007, Donaldson co-founded the Osiris Coalition to tackle the city’s dormant Certificate of Preference program, in which the Redevelopment Agency issued a document to displaced residents and businesses in the 1960s promising that they could return.

He also tried to rescue some 700 foreclosed properties and recycle them as affordable housing stock. And now he is trying to prevent the city from bulldozing seven SF Hope projects without guaranteeing residents that they have right to remain.

In 2007, Mayor Gavin Newsom and Maxwell convened an African American Outmigration Task Force that didn’t get a public hearing about its findings until August 2008. The timing angered some, who questioned why the report’s findings and implications for urban planning weren’t released before June 2008, when the residents of San Francisco voted for the Lennar-led Proposition G, a proposal to build 10,000 market rate homes at one of San Francisco’s last remaining black communities, which Newsom and Maxwell endorsed.

The taskforce didn’t publish its recommendations until the end of 2009, allegedly because of insider squabbling. Meanwhile, gentrification was going on actively, and many blamed Newsom, and by extension Maxwell, for failing to do anything with the group’s findings as D10 residents continued to suffer from high rates of asthma, cancer, unemployment and an ongoing black exodus.

It wasn’t always this way. In the 1940s, the district’s black population exploded when migrants from the south and World War II veterans came to work at the Hunters Point Naval Shipyard. Some moved to Alice Griffith Public Housing complex, or Double Rock, which was built as military housing in 1962. Others relocated to the Bayview when the Redevelopment Agency took over the Fillmore/Western Addition in the ’60s and ’70s as part of a controversial urban renewal effort.

But when the Navy abandoned the shipyard in 1974, unemployment hit the black community hard. Today, hundreds of the city’s lowest income residents live in Alice Griffith’s crumbling units and endure sewage backups, no heat, cloudy drinking water and leaking ceilings, as they wait for the projects to be rebuilt.

“Generations have been trapped in the silo of public housing and cannot get out, because of lack of opportunity and education, so when we legislate, we need to take that into consideration,” said candidate Malia Cohen, whose grandfather came from Texas to work at the shipyard where he met her grandmother, whose family came from New Orleans.

“My grandfather’s father was a longshoreman. He worked with the infamous Leroy King [a commissioner at the city’s Redevelopment Agency] and he has fantastically vivid stories of racism,” said Cohen, who works for the Federal Reserve Bank of San Francisco, previously served on the executive staff of Mayor Gavin Newsom, and has already raised over $18,000 in the D10 race and qualified for public matching funds.

“My family came here to work hard, they lived on Navy road in the projects, and then they bought a house here. My parents were born here, and we were all public schooled,” Cohen recalled as she took me on a tour of D10 that ended up in Visitacion Valley, an increasingly Chinese-American neighborhood that reflects a district-wide trend.

Census data show that by 2000, Asians were the largest racial group in the district (30 percent), followed by blacks (29 percent), whites (26 percent), and Latinos (19 percent). By 2003, according to the California Urban Issues project, the trend continued. Asians were the largest racial group (32 percent), followed by blacks (27 percent), whites (21 percent) and Latinos (17 percent) of the population.

This means that D10 candidates will have to garner support from more than one ethnic group to win. Over a dozen candidates have already filed papers in the race, but so far there is no clear front-runner.

Also frustrating the prognosticators is that fact that D10 has had the lowest voter turnout in the city, so the winner will also depend on who goes to the polls.

D10 candidate Geoffrea Morris, who is the grand daughter of longtime Bayview activist Charlie Walker, has been knocking on doors and participating in voter registration drives.

“We need new blood,” Morris said

Getting elected will be a complicated equation. Although Bayview’s population was 50 percent African American at the time of the 2000 census, it didn’t turn out the vote. In the 2006 election, only 14,000 of the district’s 37,000 registered voters went to the ballot, and 50 percent were from whiter, richer, and more Asian neighborhoods.

“It’s very important to the future of the city that the ethnicity diversity of the board be maintained and that the African American community have representation,” former Board President and current Democratic Party chair Aaron Peskin told the Guardian.

Maxwell recently told the Guardian that she’s not ready to endorse any D10 candidates yet. “I’m waiting for people to have a better understanding of what this community is, what the common thread running through it is, and how to use rank choice voting,” she told us.

The only candidate who currently holds elected office is BART director Lynette Sweet, who had her answers down pat when we reached her by phone, and even used wording that was eerily similar to Maxwell’s words.

“D10 is a pretty diverse district, but there is only one common thread: the need for economic development,” Sweet told me. “That’s true in Potrero Hill, Portola, Dog Patch and the Bayview. It’s the same mantra: a lot of small businesses need help, and the only way to help them is through economic development. In Potrero Hill it’s about land use. In the Bayview, it’s about the shipyard and better transportation and truancies.”

 

THE COMMON THREAD

District 10 is ground zero for the Lennar’s $2.2 billion plan to develop 10,500 market rate condos at the Shipyard and Candlestick Point. The plan will allegedly create thousands of jobs and new parks, deliver on an historic community benefits agreement that labor groups claim is so “lawyered up” that the developer can’t renege on its promises.

The package is framed as the one and only way to revitalize the southeast’s formerly vibrant economic engine. Indeed, any time anyone tries to slow down the process—to take time to thoroughly read the draft EIR and see if it adequately addresses the impacts of this massive urban reengineering project — a chorus of “no delays” starts up, either from residents of the housing projects desperate to see their homes rebuilt, or the labor contractors who hope to get jobs.

“It’s as if the city is playing checkers, while Lennar is playing three-dimensional chess,” Eric Smith observed.

Lennar has stated that it will contribute $711 million to finance this massive project. The remainder will be leveraged by Mello-Roos bonds, state taxes based on the use and size of a property and intended to raise money for needed services, and tax increment financing, which creates funding for projects by borrowing against future property tax revenues.

The conceptual plan won Maxwell’s backing but environmental groups are critical of the draft EIR.

During DEIR hearing, environmentalists questioned the wisdom and the cost of filling the Bay to build a bridge over Yosemite Slough, and building condos on Candlestick Point state recreation area, the only open major open space in the district.

But the city’s Planning Department also has 20,000-30,000 units of housing in its pipeline. This means that if all these plans get approved in the next decade, they’d account for 80 percent of residential development citywide. And D10’s population could triple, further skewing the district’s already shifting demographics.

In other words, D10 as we know it could become nothing more than a historic relic in a few years, and the next supervisor will play a key role in deciding whether that happens. SFHDC’s Ed Donaldson warns that any supervisor who does not understand the complexity of the city’s largest district can expect a similar recall backlash in future.

“There is no one homogenous voice in the community,” Donaldson said. “The grass-roots organizing that brought about the recall effort was a result of a changing political structure in the area, but is not yet on par with other districts in town. We still allow our politics to be controlled from downtown.”

Fellow candidate Eric Smith warns that the issues—and politics—are complex.

“People were emotional, angry, and desperate because they feel no one listens to them,” Smith said. “That’s part of the problem here; they would rather have a supervisor go down swinging for them, rather than watch one seemingly side with Lennar, PG&E and the mayor on issues contrary to their interests. That’s the terrible irony and one of the biggest problems in District 10. Folks are so mad, they’re willing to do whatever it takes to make them feel they have a voice in the outcome, even if it’s potentially worse.”

Smith cited the sequence of events that culminated last year in the Navy dissolving the community-based shipyard Restoration Advisory Board (RAB), which for years has reviewed technical documents and commented on the Navy’s clean-up proposals. But in December, the Navy made its official decision to disband the RAB, citing dysfunctional behavior and off-topic discussions that got in the way.

“Some of the same folks who were frustrated by the process, tried to send a signal to the Navy that they weren’t being heard and for all their well-intentioned efforts got the RAB dissolved,” Smith said. “I truly feel for them, it’s absolutely heartbreaking, but at times, they can be their own worst enemy.”

One of the looming issues about the shipyard is that the land has been polluted and needs to be cleaned. The shipyard contains radioactive debris from ships towed to the shipyard, after a 90-foot wave washed over them during an atomic test gone awry. The Navy burned 610,000 gallons of radioactively contaminated ship fuel at the shipyard, and workers showered on the shipyard, raising concerns that radioactive materials got into the drains and sewers. And questions have been raised about radiological tests on animals at the yard.

 

LEAKS AND FLOODS

It’s not just the shipyard that’s toxic. Even the buildings that were constructed to house workers 50 years ago are a serious mess.

Realtor Diane Wesley Smith, who grew up in public housing projects, took me on a walking tour of Alice Griffith last week to see conditions that tenants will likely have to endure until at least 2014, if the city sticks to its plan to relocate people into a new replacement unit in the same geographical area, if not the exact same site.

What we found was pretty messed up.

“The water sometimes comes out brown and feels like sand. It’s been like that for a year,” one resident said.

“The water is cloudy, the bath tub isn’t working and the sink keeps stopping up,” said another.

A woman named Silvia showed us how the water from the tap in her elderly mother’s kitchen flows out cloudy and then doesn’t settle properly, like foamy beer.

“The roof’s been leaking for years, the sewage backs up, but they just fixed the lights,” Silvia said. A neighbor named Linda was using her oven as a heater.

“The toilet backs up a lot, and my grandson’s been coughing a lot from asthma,” Linda said.

“Roaches is always a problem,” said a woman named Stormi, dressed in black sweats and a black T-shirt that read, “Can’t knock the hustle.”

“They’re trying,” said Stormi, a member of the Alice Griffith Residents Association, as a couple of Housing Authority trucks pulled up to do repairs.

“They promise that you will not have to leave your unit, but if they try to move us down to the waterfront, well, there’s a reason there’s no housing there, and it’s because the land will flood,” Stormi said.

“If we don’t end up at the table, we’ll end up on the menu,” Wesley Smith warned, as she stopped to chat with a group of young men, who were worried they would pushed out of the Alice Griffith rebuild through the criteria being established.

“Fred Blackwell, the executive director of the Redevelopment Agency, assures me that’s not the case, but Alice Griffith is a Housing Authority property, and empty promises have the potential to be great promises provided they are made in writing,” Wesley Smith said as we walked out of the projects and onto the road where a yellow and black sign announced “flooded” next to Candlestick Point park, where Lennar wants to build.

Malia Cohen expressed concern about Hope SF residents, as we drove through the Sunnydale housing project.

“We have to be diligent and mindful that people are not pushed out,” Cohen said, noting the sweeping views at Gleneagles golf course above Sunnydale, and the value of housing for a golf course community. “When public housing gets taken offline, we must work with Redevelopment and the Housing Authority to make sure no one is changing the rules halfway. We have to make sure the talks and walks line up. We need to be equal partners. We cannot be bulldozed by City Hall.”

Geoffrea Morris is a Calworks employee, at the Southeast Community College facility on Oakdale, which was built to mitigate the city’s expansion of the sewage plant in 1987. She cited concerns about the literacy levels of people who live in the 2200 public housing units that cluster D10. “A lot of people in Alice Griffith don’t even know the dates or when it’s going to be reconstructed,” Morris said. “Folks like to be told stuff like that, but the city gives you a stack of papers. Some will read them, but others rely on folks they think are trustworthy. They need stuff in layman’s terms written on one sheet of paper.”

Morris is a fan of the Internet who posted a community survey online, and made sure every housing project got some literature telling people to get informed. She worries about the digital divide in D10:

“A lot of folks don’t have computers and access to important information,” Morris said. “And let’s talk about the way ‘affordable’ is used to trick people.”

Michael Cohen, Newsom’s top economic adviser, recently stated in a memo that over the expected 15-20 year phased build out, Lennar’s Candlestick-Shipyard development would include, “up to 10,500 residential units, about 32 percent of which (3,345) will be offered at below market rates.”

“But 892 units of this ‘affordable category’ will be sold to folks earning $100,000,” Morris said. “So if you subtract 892 units from affordable unit category, you’re back to 25 percent affordable.”

Candidate Kristine Enea, an attorney and a former RAB member, chairs the India Basin Neighborhood Association, which administers a US EPA grant to hire experts to translate the Navy’s cleanup documents into plain English and comment on them She was frustrated by the Navy’s decision to dissolve the RAB.

“The lack of a forum does nothing to bolster the community’s trust in the cleanup or the redevelopment process,” Enea said.

Enea generally supports the Lennar project, but has concerns about whether it will adequately mitigate increased car traffic, or result in commercial development that benefits her neighborhood.

“India basin is a pocket of Hunters Point right along the shoreline,” Enea said. “Right now, we have no shops or restaurants, no ATM, no groceries, nothing beyond one liquor store and a few industrial businesses.

Potrero Boosters president Tony Kelly told us that District 10 residents can think for themselves. “D10 residents don’t need to rely on corporations to solve their problems,” he said.

“Folks in the eastern neighborhoods came up with a better revitalization plan than what the city proposed and community activists managed to close the power plant, after the city said it was impossible,” Kelly recalled.

And there’s no shortage of good ideas.

Kelly suggested that an urban agriculture center could immediately put low-skilled folks to work by erecting greenhouses on unused land. Smith said the industrial zone could be “incredible eco-park made from sustainable sources.

‘D 10 is the dumping ground for everything, including all the city’s waste,” he said. “We could be a shining example, not just for D 10, but the rest of the state.”

The D 10 candidate line up includes Calloway, Cohen, Donaldson, Smith, Enea: civil rights attorney Dewitt Lacy, Morris, Potrero View publisher Steve Moss; District 7 BART director Lynette Sweet, Wesley-Smith. Bill Barnes, who works for Sup. Michela Alioto-Pier, and Linda Richardson, who was appointed to the Human Rights Commission in 2007 by Mayor Newsom, have also expressed interest in the race.

In such a huge field, name identification will play a major role. Sweet is in office, but BART Board is not a high-profile job and won’t give her a huge advantage.

Cohen has a slight edge right now in that she’s raised $18,505, including $500 from former Newsom flak Peter Ragone, making her the first D. 10 candidate to qualify for campaign financing. The oldest of five girls, Cohen recalls how her mother got laid off from her city job as a school-based mental health worker and then rehired, as part of the city’s budget cuts.

“We felt that pinch and the frustrating games that are played out between the leadership and the rank and file,” she said.

Cohen who worked for Newsom in his first term as mayor, but has since left his administration , said she is uncomfortable at being framed as Newsom’s candidate.

“Because I’m not, but I am one of the few candidates who has seen how the mayor and the Board work—and don’t work—together,” she said.

Moss sees the city’s southeast as a “district in transition.” Over coffee at Farley’s in Potrero Hill, he told me that the southeastern neighborhoods could be “launching pads for environmentally sustainable growth.”

“The district’s been in a frozen period for 30 years, But despite the problems, people are deeply committed to and in love with their community.

“This district is the future of San Francisco and its social fabric—the diversity, income –and its problems are leftovers from the city’s industrial age.”

DEIR in the headlights

GREEN CITY Public comments on the city’s draft environmental impact report (DEIR) for Lennar Corp.’s massive redevelopment proposal on Candlestick Point and the Hunters Points Shipyard includes complaints that the comment period was too short (see “The Candlestick Farce,” 12/23/09), concerns that the city violated state requirements to notify the Ohlone Tribe, and frustration that the city’s preferred plan represents the most significant and substantial impacts of any of the five scenarios analyzed in the DEIR.

These and many other concerns about the impacts of the 10,500-home project will need to be addressed in the final EIR, which Mayor Gavin Newsom and other project proponents expect to be completed by June.

Some object that the city is considering an early transfer of the shipyard and would undertake activities that are currently the Navy’s responsibility (see “Eliminating Dissent,” 06/17/09), saying the final EIR should prominently reference Proposition P, which voters approved in 2000, establishing community acceptance criteria for the cleanup.

Saul Bloom, executive director of Arc Ecology, submitted his organization’s comments “under protest for the inadequate extension of the public comment period, which we believe unfairly penalizes the public review of the draft EIR.”

Land use attorney Sue Hestor called the public comment submission schedule “abusive” in comments submitted for POWER (People Organized to Win Employment Rights). “The schedule is being driven by an insane desire to have the final EIR certified and all local approvals done by June,” Hestor said.

Ohlone chairperson Ann Marie Sayers and Neil MacClean of the Ohlone Profiles Project wondered why the Planning Department did not contact anyone on the city’s list of official Ohlone representatives. “We want the SF Planning Department to follow Senate Bill 18, which requires them to include Ohlone people in the planning process,” MacClean said, noting that there are at least four Ohlone villages within the proposed development area.

Jaime Michaels, coastal program analyst for the San Francisco Bay Conservation and Development Commission, expressed concerns about the DEIR’s proposal to make a 23.5 acre reduction in existing state park boundaries (see “Can I buy your park?” 08/12/09).

Project proponents, Michaels said, “would need to demonstrate that the decreased area would not compromise or reduce its value as a park/beach facility.” Michaels also worries about the impact of adding a minimum of 1.7 acres of fill in the bay to accommodate a bridge at Yosemite Slough, a plan she described as “a significant amount of coverage, particularly for a facility where the large majority of its coverage is needed to serve vehicles accessing the new stadium only 12 days a year.”

Michaels expressed concerns that the project’s plans to address sea level rise would negatively affect bay views and public access to the shoreline.

The project includes a 9.6-mile trail and a variety of other public amenities directly adjacent to the shoreline. Proposed building structures located away from the immediate shoreline would accommodate a 36-inch sea level rise by 2075, and the DEIR promises to employ adaptive management strategies along the perimeter beyond 2050.

“Unfortunately, partly due to illegibility and the scale of the drawings, it is difficult to assess precisely how these adaptations would appear,” Michaels observed. “However, it can be assumed that over time levees would need to be raised and likely widened at the base, thereby partly or entirely obstructing the public’s view of the bay from inland areas, encroaching on and reducing the area devoted for public use and impacting the overall public access experience.”

Arc Ecology discussed the DEIR’s failure to provide a comprehensive sustainability plan, address adjacent development projects, justify a 49ers stadium on the shipyard, or evaluate the potential for the development of port-related heavy industrial activities.

“The city is determined to get this project passed right now, and the developer is afraid that if someone else comes along as mayor and District 10 supervisor, they may not be as sympathetic,” Bloom said. “But the project — as outlined in the DEIR and the city’s way of approaching the deal — is against the interests of San Francisco.”
